Abu Mansoor al-Amriki.Abu Mansoor al-Amriki. [Source: Al-Jazeera]A militant in a video message released this month has an interesting background. The message supports Shabab, one of two radical Islamic groups fighting for power in war-torn Somalia. According to a US intelligence source, the militant in the video, Abu Mansoor al-Amriki, is an ex-US soldier who fought in Bosnia in the early 1990s. No US soldiers officially fought in the Bosnia war, but about a dozen Muslim ex-US Special Forces soldiers fought in Bosnia and trained al-Qaeda and other mujaheddin forces there around 1993 (see December 1992-June 1993). At the time, the US military and Saudi government apparently had an interest in sending Muslim ex-Special Forces there (see December 1992-June 1993 and December 1992). Mansoor is said to be a high-ranking member of al-Qaeda’s East Africa leadership, and is a lead trainer for Somali insurgent forces. Although he only appears on video wearing a face mask, it is clear that he is Caucasian. (Gartenstein-Ross 2/28/2008)

Nick Davies, author of a new book, Flat Earth News, claims that since the 9/11 attacks, the US has engaged in a systematic attempt to manipulate world opinion on Iraq and Islamist terrorism by creating fake letters and other documents, and then releasing them with great fanfare to a credulous and complicit media.
Al-Zarqawi Letter - Davies cites as one example a 2004 letter purporting to be from al-Qaeda leader Abu Musab al-Zarqawi that became the basis of an alarming news report in the New York Times and was used by US generals to claim that al-Qaeda was preparing to launch a civil war in Iraq (see February 9, 2004). The letter is now acknowledged to have almost certainly been a fake, one of many doled out to the world’s news agencies by the US and its allies. Davies writes: “For the first time in human history, there is a concerted strategy to manipulate global perception. And the mass media are operating as its compliant assistants, failing both to resist it and to expose it.” Davies says the propaganda is being generated by US and allied intelligence agencies working without effective oversight. It functions within a structure of so-called “strategic communications,” originally designed by the US Defense Department and the North Atlantic Treaty Organization (NATO) to use what Davies calls “subtle and non-violent tactics to deal with Islamist terrorism,” but now being used for propaganda purposes. Davies notes that al-Zarqawi was never interested in working with the larger al-Qaeda network, but instead wanted to overthrow the Jordanian monarchy and replace it with an Islamist theocracy. After the 9/11 attacks, when US intelligence was scouring the region for information on al-Qaeda, Jordan supplied the US with al-Zarqawi’s name, both to please the Americans and to counter their enemy. Shortly thereafter, the US intelligence community began placing al-Zarqawi’s name in press releases and news reports. He became front-page material after being cited in Colin Powell’s UN presentation about Iraqi WMDs and that nation’s connections with al-Qaeda (see February 5, 2003). The propaganda effort had an unforeseen side effect, Davies says: it glamorized al-Zarqawi so much that Osama bin Laden eventually set aside his differences with him and made him the de facto leader of al-Qaeda in Iraq. Davies cites other examples of false propaganda besides the Zarqawi letter:
bullet Tales of bin Laden living in a lavish network of underground bases in Afghanistan, “complete with offices, dormitories, arms depots, electricity and ventilation systems”;
bullet Taliban leader Mullah Omar “suffering brain seizures and sitting in stationary cars turning the wheel and making a noise like an engine”;
bullet Iran’s ayatollahs “encouraging sex with animals and girls of only nine.”
Davies acknowledges that some of the stories were not concocted by US intelligence. An Iranian opposition group produced the story that Iranian President Mahmoud Ahmadinejad was jailing people for texting each other jokes about him. Iraqi exiles filled the American media “with a dirty stream of disinformation about Saddam Hussein.” But much of it did come from the US. Davies cites the Pentagon’s designation of “information operations” as its fifth “core competency,” along with land, air, sea, and special forces. Much of the Pentagon’s “information operations,” Davies says, is a “psyops” (psychological operations) campaign generating propaganda: it has officials in “brigade, division and corps in the US military… producing output for local media.” The psyops campaign is linked to the State Department’s campaign of “public diplomacy,” which Davies says includes funding radio stations and news Web sites. Britain’s Directorate of Targeting and Information Operations in the Ministry of Defense “works with specialists from 15 UK psyops, based at the Defense Intelligence and Security School at Chicksands in Bedfordshire.”
Some Fellow Journalists Skeptical - The Press Association’s Jonathan Grun criticizes Davies’s book for relying on anonymous sources, “something we strive to avoid.” Chris Blackhurst of the Evening Standard agrees. The editor of the New Statesman, John Kampfner, says that he agrees with Davies to a large extent, but he “uses too broad a brush.” (Davies 2/11/2008) Kamal Ahmad, editor of the Observer, is quite harsh in his criticism of Davies, accusing the author of engaging in “scurrilous journalism,” making “wild claims” and having “a prejudiced agenda.” (Davies singles out Ahmad for criticism in his book, accusing Ahmad of being a “conduit for government announcements” from Downing Street, particularly the so-called “dodgy dossier” (see February 3, 2003).) (Savage 2/11/2008) But journalist Francis Wheen says, “Davies is spot on.” (Davies 2/11/2008)

A judge says that the FBI has no evidence against Steven Hatfill, who has been the only publicly named suspect so far in the 2001 anthrax attacks (see October 5-November 21, 2001). Reggie Walton, the federal judge presiding over a lawsuit brought by Hatfill against the Justice Department and the FBI for damaging his reputation, says in court, “There is not a scintilla of evidence that would indicate that Dr. Hatfill had anything to do with [the anthrax attacks].” Walton has reviewed four still secret FBI memos about the status of the anthrax investigation. (Willman 6/28/2008) Later in the year, Hatfill will settle with the government and will be awarded $6 million (see June 27, 2008).

Convicted felon Lewis “Scooter” Libby (see March 6, 2007), formerly the chief of staff for Vice President Dick Cheney, is disbarred from practicing law. The US Court of Appeals for the District of Columbia rules that when a lawyer “is convicted of an offense involving moral turpitude, disbarment is mandatory.” (CBS News 1/25/2007; Reuters 3/20/2008) Libby’s conviction was commuted by President Bush months before (see July 2, 2007). Libby has already been suspended from practicing law. Libby says he will not challenge the disbarment. (Jeralyn Merritt 3/20/2008; Reuters 3/20/2008)

Norman Solomon, author of War Made Easy, a study of the military’s influence on the US media and American public opinion, observes that while some commercial news networks are pointed out as unduly biased in favor of the administration’s viewpoint on Iraq, National Public Radio (NPR) is often viewed as a source of left-wing, anti-administration opinion. Solomon shows that just the opposite is usually the case. He begins by noting an NPR reporter’s comment on the Iraqi government’s large-scale military assault against Shi’ite insurgents in Basra today: “There is no doubt that this operation needed to happen.” Solomon writes, “Such flat-out statements, uttered with journalistic tones and without attribution, are routine for the US media establishment.” Solomon observed in the documentary film made from his book: “If you’re pro-war, you’re objective. But if you’re anti-war, you’re biased. And often, a news anchor will get no flak at all for making statements that are supportive of a war and wouldn’t dream of making a statement that’s against a war.” Solomon says that after considerable examination of NPR’s flagship news programs, “Morning Edition” and “All Things Considered,” “the sense and sensibilities tend to be neatly aligned with the outlooks of official Washington. The critical aspects of reporting largely amount to complaints about policy shortcomings that are tactical; the underlying and shared assumptions are imperial. Washington’s prerogatives are evident when the media window on the world is tinted red-white-and-blue.” Like other news networks, NPR routinely uses Pentagon-approved “military analysts” (see April 20, 2008 and Early 2002 and Beyond) to give commentary and analysis that is almost always supportive of the administration’s Iraq operations and strategies. Solomon writes: “Such cozy proximity of world views, blanketing the war maker and the war reporter, is symptomatic of what ails NPR’s war coverage—especially from Washington. Of course there are exceptions. Occasional news reports stray from the narrow baseline. But the essence of the propaganda function is repetition, and the exceptional does not undermine that function. To add insult to injury, NPR calls itself public radio. It’s supposed to be willing to go where commercial networks fear to tread. But overall, when it comes to politics and war, the range of perspectives on National Public Radio isn’t any wider than what we encounter on the avowedly commercial networks.” (Solomon 3/27/2008)

Fox News reports that the FBI has narrowed its focus to “about four” suspects in its investigation of the 2001 anthrax attacks (see October 5-November 21, 2001). At least three of them are said to be scientists linked to USAMRIID, the US Army’s bioweapons lab at Fort Detrick, Maryland. One is said to be a former deputy commander, another is a leading anthrax scientist, and another is a microbiologist. None of them are said to be Steven Hatfill, a scientist who once worked at USAMRIID and was previously suspected. Fox News reports that the attacks came from a USAMRIID scientist or scientists, and, “A law enforcement source said the FBI is essentially engaged in a process of elimination.” Fox News also claims to have obtained an e-mail of USAMRIID scientists discussing how the anthrax powder they had been asked to analyze after the attacks was nearly identical to that made by one of their colleagues. The undated e-mail reads: “Then he said he had to look at a lot of samples that the FBI had prepared… to duplicate the letter material. Then the bombshell. He said that the best duplication of the material was the stuff made by [name redacted]. He said that it was almost exactly the same… his knees got shaky and he sputtered, ‘But I told the general we didn’t make spore powder!’” (Herridge and McCaleb 3/28/2008) In August 2008, one of the authors of the Fox News story will say that one of the four suspects was Bruce Ivins, and the e-mail was from 2005 and forwarded by Ivins, but not written by him. (Fox News 8/4/2008)

[Source: Princeton ROTC]General David Petraeus, the newly named commander of CENTCOM and the supreme commander of US forces in the Middle East, takes time out from testifying to Congress to speak in a conference call to a group of the Pentagon’s carefully groomed “military analysts,” whom it uses regularly to promote the occupation of Iraq and sell the administration’s Middle East policies (see April 20, 2008 and Early 2002 and Beyond). John Garrett, a retired Marine colonel and Fox News analyst, tells Petraeus to “keep up the great work.” In an interview, Garrett reaffirms his intention to continue selling the occupation of Iraq: “Hey, anything we can do to help.” (Barstow 4/20/2008)

[Source: New York Times]The New York Times receives 8,000 pages of Pentagon e-mail messages, transcripts and records through a lawsuit. It subsequently reports on a systematic and highly orchestrated “psyops” (psychological operations) media campaign waged by the Defense Department against the US citizenry, using the American media to achieve their objectives. At the forefront of this information manipulation campaign is a small cadre of retired military officers known to millions of TV and radio news audience members as “military analysts.” These “independent” analysts appear on thousands of news and opinion broadcasts specifically to generate favorable media coverage of the Bush administration’s wartime performance. The group of officers are familiar faces to those who get their news from television and radio, billed as independent analysts whose long careers enable them to give what New York Times reporter David Barstow calls “authoritative and unfettered judgments about the most pressing issues of the post-Sept. 11 world.” However, the analysts are not nearly as independent as the Pentagon would like for Americans to believe. Barstow writes: “[T]he Bush administration has used its control over access and information in an effort to transform the analysts into a kind of media Trojan horse—an instrument intended to shape terrorism coverage from inside the major TV and radio networks.… These records reveal a symbiotic relationship where the usual dividing lines between government and journalism have been obliterated.”
Administration 'Surrogates' - The documents repeatedly refer to the analysts as “message force multipliers” or “surrogates” who can be counted on to deliver administration “themes and messages” to millions of Americans “in the form of their own opinions.” According to the records, the administration routinely uses the analysts as, in Barstow’s words, “a rapid reaction force to rebut what it viewed as critical news coverage, some of it by the networks’ own Pentagon correspondents.” When news articles revealed that US troops in Iraq were dying because of inadequate body armor (see March 2003 and After), a senior Pentagon official wrote to his colleagues, “I think our analysts—properly armed—can push back in that arena.” In 2005, Ten analysts were flown to Guantanamo to counter charges that prisoners were being treated inhumanely; the analysts quickly and enthusiastically repeated their talking points in a variety of television and radio broadcasts (see June 24-25, 2005).
Ties to Defense Industry - Most of the analysts, Barstow writes, have deep and complex “ties to military contractors vested in the very war policies they are asked to assess on air.” The analysts and the networks almost never reveal these business relationships to their viewers; sometimes even the networks are unaware of just how deep those business connections extend. Between then, the fifty or so analysts “represent more than 150 military contractors either as lobbyists, senior executives, board members or consultants. The companies include defense heavyweights, but also scores of smaller companies, all part of a vast assemblage of contractors scrambling for hundreds of billions in military business generated by the administration’s war on terror. It is a furious competition, one in which inside information and easy access to senior officials are highly prized.” Some of the analysts admit to using their special access to garner marketing, networking, and business opportunities. John Garrett, a retired Marine colonel and Fox News analyst, is also a lobbyist at Patton Boggs who helps firms win Pentagon contracts, including from Iraq. In company promotional materials, Garrett says that as a military analyst he “is privy to weekly access and briefings with the secretary of defense, chairman of the Joint Chiefs of Staff and other high level policy makers in the administration.” One client told investors that Garrett’s access and experience helps him “to know in advance—and in detail—how best to meet the needs” of the Defense Department and other agencies. Garrett calls this an inevitable overlap between his various roles, and says that in general, “That’s good for everybody.”
Exclusive Access to White House, Defense Officials - The analysts have been granted unprecedented levels of access to the White House and the Pentagon, including:
bullet hundreds of private briefings with senior military officials, including many with power over contracting and budget matters;
bullet private tours of Iraq;
bullet access to classified information;
bullet private briefings with senior White House, State Department, and Justice Department officials, including Vice President Dick Cheney, former Attorney General Alberto Gonzales, and National Security Adviser Stephen Hadley.
Conversely, analysts who do not cooperate take a risk. “You’ll lose all access,” says CBS military analyst and defense industry lobbyist Jeffrey McCausland.
Quid Pro Quo - Fox News analyst and retired Army lieutenant colenel Timur Eads, who is vice president of government relations for Blackbird Technologies, a rapidly growing military contractor, later says, “We knew we had extraordinary access.” Eads confirms that he and other analysts often held off on criticizing the administration for fear that “some four-star [general] could call up and say, ‘Kill that contract.’” Eads believes that he and the other analysts were misled about the Iraqi security forces, calling the Pentagon’s briefings about those forces’ readiness a “snow job.” But Eads said nothing about his doubts on television. His explanation: “Human nature.” Several analysts recall their own “quid pro quo” for the Pentagon in the months before the invasion (see Early 2003). And some analysts were far more aboveboard in offering quid pro quos for their media appearances. Retired Army general Robert Scales, Jr, an analyst for Fox News and National Public Radio, and whose consulting company advises several firms on weapons and tactics used in Iraq, asked for high-level Pentagon briefings in 2006. In an e-mail, he told officials: “Recall the stuff I did after my last visit. I will do the same this time.”
Repeating White House Talking Points - In return, the analysts have, almost to a man, echoed administration talking points about Iraq, Afghanistan, and Iran, even when some of them believed the information they were given was false or inflated. Some now acknowledge they did so—and continue to do so—for fear of losing their access, which in turn jeopardizes their business relationships. Some now regret their participation in the propoganda effort, and admit they were used as puppets while pretending to be independent military analysts. Bevelacqua says, “It was them saying, ‘We need to stick our hands up your back and move your mouth for you.’” Former NBC analyst Kenneth Allard, who has taught information warfare at the National Defense University, calls the campaign a sophisticated information operation aimed, not at foreign governments or hostile populaces, but against the American people. “This was a coherent, active policy,” he says (see Late 2006). The Pentagon denies using the military analysts for propaganda purposes, with spokesman Bryan Whitman saying it was “nothing other than an earnest attempt to inform the American people.” It is “a bit incredible” to think retired military officers could be “wound up” and turned into “puppets of the Defense Department,” Whitman says. And other analysts, such as McCausland, say that they never allowed their outside business interests to affect their on-air commentaries. “I’m not here representing the administration,” McCausland says. Some say they used their positions to even criticize the war in Iraq. But according to a close analysis of their performances by a private firm retained by the Pentagon to evaluate the analysts, they performed to the Pentagon’s complete satisfaction (see 2005 and Beyond).
Enthusiastic Cooperation - The analysts are paid between $500 and $1,000 per appearance by the networks, but, according to the transcripts, they often speak as if the networks and the media in general are the enemy. They often speak of themselves as operating behind enemy lines. Some offered the Pentagon advice on how to outmaneuver the networks, or, as one said to then-Defense Secretary Donald Rumsfeld, “the Chris Matthewses and the Wolf Blitzers of the world.” Some alerted Pentagon officials of planned news stories. Some sent copies of their private correspondence with network executives to the Pentagon. Many enthusiastically echoed and even added to administration talking points (see Early 2007). (Barstow 4/20/2008) Several analysts say that based on a Pentagon briefing, they would then pitch an idea for a segment to a producer or network booker. Sometimes, the analysts claim, they even helped write the questions for the anchors to ask during a segment. (Barstow 4/21/2008)
Consequences and Repercussions - Some of the analysts are dismayed to learn that they were described as reliable “surrogates” in Pentagon documents, and some deny that their Pentagon briefings were anything but, in the words of retired Army general and CNN analyst David Grange, “upfront information.” Others note that they sometimes disagreed with the administration on the air. Scales claims, “None of us drink the Kool-Aid.” Others deny using their access for business gain. Retired general Carlton Shepperd says that the two are “[n]ot related at all.” But not all of the analysts disagree with the perception that they are little more than water carriers for the Pentagon. Several recall being chewed out by irate defense officials minutes after their broadcasts, and one, retired Marine colonel Wiliam Cowan of Fox News, recalls being fired—by the Pentagon, not by Fox—from his analyst position after issuing a mild criticism of the Pentagon’s war strategies (see August 3-4, 2005). CNN media critic Howard Kurtz writes a scathing op-ed expressing his dismay at the extent of the Pentagon’s secret propaganda operation to sell the Iraq war, and its use of retired military officers to promote its agenda and make its case on nightly news broadcasts (see April 20, 2008 and Early 2002 and Beyond). Kurtz observes: “It’s hardly shocking that career military men would largely reflect the Pentagon’s point of view, just as Democratic and Republican ‘strategists’ stay in touch with aides to the candidates they defend on the air. But the degree of behind-the-scenes manipulation—including regular briefings by then-Defense Secretary Donald Rumsfeld and other officials—is striking, as is the lack of disclosure by the networks of some of these government and business connections. With an aura of independence, many of the analysts used their megaphones, and the prestige of their rank, to help sell a war that was not going well.… [T]he networks rarely if ever explored the outside roles of their military consultants.” While both the Pentagon and the various networks have defended their use of the military analysts, and the networks have tried to explain their failure to examine their analysts’ connections to an array of defense firms—“it’s a little unrealistic to think you’re going to do a big background check on everybody,” says Fox News executive producer Marty Ryan—the reality, as Kurtz notes, is far less aboveboard. Kurtz adds, “The credibility gap, to use an old Vietnam War phrase, was greatest when these retired officers offered upbeat assessments of the Iraq war even while privately expressing doubts,” a circumstance reported on the part of numerous analysts in the recent New York Times expose. William Arkin.William Arkin. [Source: New York Times]Washington Post columnist William Arkin writes that from 1999 until late 2007, he was a military analyst for NBC News, “one of the few non-generals in that role.” Arkin writes that he worked with several generals retained by NBC and MSNBC, “and found them mostly to be valuable.” Arkin writes that “[t]he problem is not necessarily that the networks employ former officers as analysts, or that the Pentagon reaches out to them. The larger problem is the role these general play, not just on TV but in American society. In our modern era, not-so-old soldiers neither die nor fade away—they become board members and corporate icons and consultants, on TV and elsewhere, and even among this group of generally straight-shooters, there is a strong reluctance to say anything that would jeopardize their consulting gigs or positions on corporate boards.”
McCaffrey a Consistent Voice of Criticism - Retired general Barry McCaffrey (see April 21, 2003) stands out in Arkin’s recollection as one of the most consistent critics of the Pentagon, “and to this day he is among the most visible of the paid military analysts on television.” Arkin recalls McCaffrey as well-informed and sincere, but writes that “much of his analysis of Iraq in 2003 was handicapped by a myopic view of ground forces and the Army, and by a dislike of then-Secretary of Defense Donald Rumsfeld that was obvious and outspoken. (To be fair to McCaffrey, few former or active duty generals read the war or its aftermath correctly.)”
Analysts 'Invaluable' during Hostilities - In 2003, the reporters and camera crews embedded in the particular military units “gave an almost-live view of a war at the tactical level.” The generals were on the air to make sense of the ground-level tactical information, and translate it into a more general understanding of events and strategies. “The generals would use their knowledge and plumb their contacts to get a sense of what the divisions and corps and the coalition formations were doing at a higher level.” Arkin writes that, considering the obfuscation and deliberate deception routinely practiced by Rumsfeld and US commander General Tommy Franks, “the generals were invaluable. When they made the effort, they could go places and to sources that the rest of us couldn’t. That the Pentagon was ‘using’ them to convey a line is worrisome for the public interest but not particularly surprising.”
Pushing the Pentagon's Viewpoint - Arkin continues: “On the war itself—on the actions of the US military in March and April of 2003—there was an official line that was being pushed by the Pentagon and the White House. I’m not convinced that the generals (at least those who were serving at NBC) were trumpeting an official line that was being fed to them, but neither am I convinced that their ‘experience’ or professional expertise enabled them to analyze the war any better than non-generals or the correspondents in Washington or out in the field.” McCaffrey stands out in Arkin’s mind as one analyst who “publicly lambasted the war plan—during a time of war! In the grand scheme of things, though, I’m not sure that McCaffrey was right—and I’m not sure that having more troops then, given our assumptions about what would happen in postwar Iraq and our ignorance of the country and its dynamics, would have made much of a difference. In other words, we still could have won the battle and lost the war.”
Diminished Value as Occupation Continued - Once “major” fighting was over and other issues besides battlefield outcomes dominated the news—the disastrous occupation, the developing insurgency, the torture of prisoners—“the value of the American generals as news commentators diminished significantly,” Arkin writes. “They were no longer helping us to understand battles. They were becoming enmeshed in bigger political and public policy and partisan battles, and as ‘experts’ on the military, they should have known better not to step too far outside their lane. The networks should also have known this, and indeed they did learn eventually, as there are certainly far fewer generals on the payroll today than there were at the height of the ‘fighting.’”
A Broader Perspective - Arkin concludes: “It’s now clear that in the run-up to the war, during the war in 2003 and in its aftermath, we would have all benefited from hearing more from experts on Iraq and the Middle East, from historians, from anti-war advocates. Retired generals play a role, an important one. But for the networks, they played too big of a role—just as the ‘military’ solutions in Iraq play too big of a role, just as the military solutions in the war against terrorism swamp every other approach.” (Arkin 4/22/2008)

[Source: Nieman Watchdog]Former Washington Post editor Barry Sussman, the head of the Nieman Watchdog project at Harvard University, asks a number of pertinent questions about the recently exposed Pentagon propaganda operation that used retired military officers to manipulate public opinion in favor of the Iraq occupation (see April 20, 2008 and Early 2002 and Beyond). Sussman notes that “[t]he story has implications of illegal government propaganda and, possibly, improper financial gains,” and asks the logical question, “So what happened to it?” It is receiving short shrift in the mainstream media, as most newspapers and almost all major broadcast news operations resolutely ignore it (see April 21, 2008, April 24, 2008, and May 5, 2008). Sussman asks the following questions in hopes of further documenting the details of the Pentagon operation:
bullet Does Congress intend to investigate the operation?
bullet Do the three presidential candidates—Democrats Hillary Clinton and Barack Obama, and Republican John McCain, have any comments (see April 28, 2008)?

bullet Former Secretary of Defense Donald Rumsfeld created the Office of Strategic Influence in 2001 (see Shortly after September 11, 2001), which was nothing less than an international propaganda operation. Rumsfeld claimed the office had been closed down after the media lambasted it, but later said the program had continued under a different name (see February 20, 2002). Does the OSI indeed still exist?
bullet Did the New York Times wait an undue period to report this story? Could it not have reported the story earlier, even with only partial documentation? Sussman notes: “Getting big stories and holding them for very long periods of time has become a pattern at the Times and other news organizations. Their rationale, often, is that the reporting hasn’t been completed. Is reporting ever completed?”
bullet Many of the military analysts cited in the story have close ties to military contractors and defense firms who make handsome profits from the war. Is there evidence that any of the analysts may have financially benefited from promoting Pentagon and Bush administration policies on the air? Could any of these be construed as payoffs? [Source: Washington Post]Representative Ike Skelton (D-MO), chairman of the House Armed Services Committee, says he is angered by the allegations of a secret Pentagon propaganda operation using retired military officers as supposedly independent media analysts (see April 20, 2008 and Early 2002 and Beyond). “There is nothing inherently wrong with providing information to the public and the press,” Skelton says. “But there is a problem if the Pentagon is providing special access to retired officers and then basically using them as pawns to spout the administration’s talking points of the day.” Skelton adds that he is deeply disturbed by the ties between the retired officers and various defense contractors. “It hurts me to my core to think that there are those from the ranks of our retired officers who have decided to cash in and essentially prostitute themselves on the basis of their previous positions within the Department of Defense,” he says. The Center for Media and Democracy’s John Stauber and author Sheldon Rampton lambast the Pentagon for its recently revealed propaganda program that, in their words, “embed[s] military propagandists directly into the TV networks as on-air commentators” (see April 20, 2008 and Early 2002 and Beyond). But Stauber and Rampton are even more critical of the media’s refusal to deal with the story. They note, “In 1971, when the [New York] Times printed excerpts of the Pentagon Papers on its front page (see March 1971), it precipitated a constitutional showdown with the Nixon administration over the deception and lies that sold the war in Vietnam. The Pentagon Papers issue dominated the news media back then. Today, however, [New York Times reporter David] Barstow’s stunning report is being ignored by the most important news media in America—TV news—the source where most Americans, unfortunately, get most of their information. Joseph Goebbels, eat your heart out. Goebbels is history’s most notorious war propagandist, but even he could not have invented a smoother PR vehicle for selling and maintaining media and public support for a war…”
Journalistic Standards Violated - According to the authors, the news outlets who put these analysts on the air committed “a glaring violation of journalistic standards.” They cite the code of ethics of the Society of Professional Journalists, which enjoins journalists and news outlets to:
bullet Avoid conflicts of interest, real or perceived;
bullet Remain free of associations and activities that may compromise integrity or damage credibility;
bullet Refuse gifts, favors, fees, free travel and special treatment, and shun secondary employment, political involvement, public office and service in community organizations if they compromise journalistic integrity;
bullet Disclose unavoidable conflicts;
bullet Be vigilant and courageous about holding those with power accountable;
bullet Deny favored treatment to advertisers and special interests and resist their pressure to influence news coverage; and
bullet Be wary of sources offering information for favors or money.
Networks' Silence a 'Further Violation of Public Trust' - The networks who used these analysts observed none of these fundamental ethical guidelines. “They acted as if war was a football game and their military commentators were former coaches and players familiar with the rules and strategies,” Stauber and Rampton write. “The TV networks even paid these “analysts” for their propaganda, enabling them to present themselves as ‘third party experts’ while parroting White House talking points to sell the war.” Stauber and Rampton call the networks’ decision to almost completely ignore the story a further “violation… of the public trust…” They fix much of the blame for the Iraq debacle on the media, noting that the war “would never have been possible had the mainstream news media done its job. Instead, it has repeated the big lies that sold the war. This war would never have been possible without the millions of dollars spent by the Bush administration on sophisticated and deceptive public relations techniques such as the Pentagon military analyst program that David Barstow has exposed.” (Stauber and Rampton 4/25/2008)

The Pentagon temporarily halts its program of briefing “independent military analysts” for their appearances on US television news broadcasts after a New York Times article alleges that the military analysts are part of a systematic propaganda and disinformation campaign (see April 20, 2008 and Early 2002 and Beyond). The announcement comes from Robert Hastings, the deputy assistant secretary of defense for public affairs. Hastings says he is concerned about allegations that the Pentagon’s relationship with the retired military officers may be improper, and is reviewing the program. “Following the allegations, the story that is printed in the New York Times, I directed my staff to halt, to suspend the activities that may be ongoing with retired military analysts to give me time to review the situation,” Hastings says. He says he did not discuss the matter with Defense Secretary Robert Gates before making his decision. (Schogol 4/26/2008; Barstow 4/26/2008)

Rosa DeLauro.Rosa DeLauro. [Source: Washington Post]A group of Democrats in Congress, dismayed and angered by recent revelations of a secret Pentagon propaganda campaign to manipulate public opinion regarding Iraq (see April 20, 2008, Early 2002 and Beyond, and April 24, 2008), calls for explanations from the parties involved. Senator Carl Levin (D-MI), chairman of the Armed Services Committee, asks Defense Secretary Robert Gates to investigate the program. Representative Rosa DeLauro (D-CT) writes to the heads of the five major television networks, asking each to provide more information about their practices for vetting and hiring so-called “independent military analysts” to provide commentary and opinion about Iraq and other US military operations and strategies. DeLauro writes, “When you put analysts on the air without fully disclosing their business interests, as well as relationships with high-level officials within the government, the public trust is betrayed.” (Barstow 4/26/2008) Senator John Kerry (D-MA) calls on the Government Accountability Office (GAO) to conduct its own investigation. Kerry asks for “the names of all senior Pentagon officials involved in this effort, and the extent of that effort; [t]he extent of the contact between Pentagon officials and the military analysts in question regarding what was said by the analysts over the public airwaves”; what financial interests the analysts had “that were in some way linked to their analysis, including a list of federal contracts that are in any way linked to the companies that employ any of the analysts in question”; to what extent those financial interests were used by Pentagon officials “to promote misleading, inaccurate or false information through the media”; how much, if any, of those interests were disclosed to the media outlets and to the public; if the propaganda program is in any way illegal; what procedures ensure that the analysts aren’t using their access to further their own business interests; and what steps Congress and the Pentagon can take “to ensure that this type of effort is not repeated.” (Senator John Kerry 4/28/2008)

Brian Williams.Brian Williams. [Source: The Onion.com]NBC News anchor Brian Williams staunchly defends NBC’s use of two military analysts, Barry McCaffrey and the late Wayne Downing, in his response to recent stories about the Pentagon’s well-orchestrated propaganda campaign using retired military officers to promote the Bush administration’s agenda in the mainstream media (see April 20, 2008 and Early 2002 and Beyond). Williams notes that he quickly became friends with both analysts, and toured Iraq four times with Downing. Williams says that neither Downing nor McCaffrey ever “gave what I considered to be the party line,” and both, particularly McCaffrey, often criticized the administration’s policies in Iraq. He calls them “tough, honest critics of the US military effort in Iraq,” “passionate patriots,” and “honest brokers” of information. He says that when they went to the Pentagon for briefings, “[t]hey never came back spun, and never attempted a conversion.” He calls them “warriors-turned-analysts, not lobbyists or politicians.” Williams also lauds a third military analyst, retired Army colonel Jack Jacobs. Jacobs, a Medal of Honor winner, is a “rock-solid” analysts who “has never hesitated to take a whack at the Pentagon brass.” After his defense of NBC’s analysts, Williams writes: “I think it’s fair, of course, to hold us to account for the military analysts we employ, inasmuch as we can ever fully know the ‘off-duty’ actions of anyone employed on an ‘of counsel’ basis by us. I can only account for the men I know best. The Times article was about the whole lot of them—including instances involving other networks and other experts, who can answer for themselves. At no time did our analysts, on my watch or to my knowledge, attempt to push a rosy Pentagon agenda before our viewers. I think they are better men than that, and I believe our news division is better than that.” (Williams 4/29/2008)

Five retired military officers respond harshly to a recent New York Times article that revealed a systematic propaganda operation conducted by the Pentagon and carried out, in part, by retired military officers serving as military analysts for the print and broadcast media (see April 20, 2008 and Early 2002 and Beyond). All five have performed as analysts for a variety of US media outlets; some still do. The five are:
bullet Retired Air Force general Thomas G. McInerney;
bullet Retired Army general Paul Vallely;
bullet Retired Navy captain Charles Nash;
bullet Retired Marine lieutenant colonel William Cowan; and
bullet Retired intelligence officer Wayne Simmons.
Intelligence Summit Members - All five are part of an organization called the International Intelligence Summit, which describes itself as “a non-partisan, non-profit, neutral forum that uses private charitable funds to bring together intelligence agencies of the free world and the emerging democracies.” McInerney and Vallely are executive board members, as is retired Navy commander Richard Marcinko, author of the Rogue Warrior series of pulp fiction novels.
Criticism of NYT Article - The five accuse the Times article, by reporter David Barstow, of “malign[ing] virtually all military analysts, accusing some of being tools of a Pentagon propaganda machine,” an assertion that they state “is flatly wrong.” They state: “We have never stated anything about defense or national security that we did not believe to be true. Equally important, we also have served the essential wartime function of helping civilians be better informed about our military, our enemies, and how the war is being conducted.” They note that some of them had “similar arrangement[s]” with the Clinton administration.
'Unconscionable Libel' - They accuse Barstow of reporting “old news,” and call his assertion that they “intentionally misled the American people for partisan political purposes or some quid pro quo personal gain… an unconscionable libel of our honor and long service to this nation.” They explain their participation in Pentagon public relations briefings as stemming from the Pentagon’s belief that “we had the credentials to do so as military professionals,” and argue, “When it comes to discussing needs and tactics of the US military, who is better suited to give advice and reliable commentary on war and peace issues than those who have spent so much of their lives in this profession?” They assert their belief that the US must “defeat Radical Islam which threatens our nation and the Free World,” and say that they “will continue to speak out honestly to the American people about national security threats” because it is “our duty.” (Tom McInerney, Paul Vallely, Charles Nash, Bill Cowan, and Wayne Simmons 4/2008)

John Murtha.John Murtha. [Source: ABC News]Representative John Murtha (D-PA), a hawkish military veteran who has built a long political career on supporting the military, says that he is “disappointed” in both the US military and the news media for being part of the Pentagon’s recently revealed Iraq propaganda operation (see Early 2002 and Beyond). Murtha says that he was struck by the fact that, in the New York Times article that revealed the operation (see April 20, 2008), even some of the military analysts who most enthusiastically repeated the Pentagon’s talking points on the airwaves “didn’t even believe what they were saying.” Murtha says: “Well, the military’s held in the highest level and the highest esteem in this country. All of us appreciate their sacrifices. I’ve gotten to the point where I now distrust the military because they have been dishonored by these kind of untruths. It used to be that I could listen to the military, they would come to me, and what they said privately they were willing to say publicly. With [former Defense Secretary Donald] Rumsfeld’s tenure, they distorted everything. And that’s the way they got by for four years because the public said, well, the military’s saying that. Well, the public’s no longer accepting that. The public realizes we made a mistake when we went in, much of the information was inaccurate and they continue to say these kind of things. So, I’m disappointed. I’m disappointed in the news media. I tell ya, till I spoke out, the news media was not honest—or afraid to come forward. And I think the tactic was, ‘we don’t give them access if they say anything bad about us.’”
Credits Blogs - Murtha credits the political blogs for keeping the story alive: “The blogs have been so important to bringing out the truth. I didn’t know what a blog was till a couple of years ago. Now, I not only know, I understand how important they are because people have an opportunity to hear the other side of what they’re saying.” (Notably, Murtha gives this interview to a news blog, the left-leaning ThinkProgress.)
Propaganda Effort in Vietnam Did Decades of Damage - Murtha reflects on the tremendous damage done by military and government propaganda campaigns during Vietnam (see March 1971). “It took us 20 years to get over Vietnam,” he says. “It took us through the Ford administration, the Carter administration, it took us into the Reagan administration because we didn’t pay for the war and the public was misled. Now the public recognized it very early on in Vietnam because they casualties were so heavy. Because of the technology increases, they didn’t recognize it as quickly in Iraq. But until the end of the Clinton administration, where we had a budget with a surplus, we were paying for the Vietnam war. We’re doing the same thing now.… I mean, nobody recognized we’re paying now with inflation, we’re paying all the expenses in Iraq. We’re paying $343 million dollars a day because of Iraq. So, it’s unfortunate and it just makes it that much more difficult for us to overcome this, because people who don’t believe it now, believed it for a while and they don’t want to be misled again.” (ThinkProgress (.org) 5/1/2008)

Jim Walton.Jim Walton. [Source: CNN]CNN president Jim Walton responds to a letter from Representative Rosa DeLauro (D-CT) demanding an explanation of his network’s involvement in the recently revealed Pentagon propaganda operation (see April 24, 2008). Walton says that his network fully cooperated with the New York Times’s investigation of the operation (see April 20, 2008), but CNN was not a part of any such operation. Indeed, Walton claims, “[m]ilitary analysts, and the handful of generals on CNN, contribute only a small portion to CNN’s overall coverage.” He acknowledges that CNN was not always as alert as it should have been to its analysts’ financial connections to defense contractors, and notes that the network fired one of its analysts after discovering “the extent of his dealings” (see July 2007). Walton concludes by assuring DeLauro that the network is committed to “protecting the public trust” and holds itself to “the highest ethical standards” of journalism. (Walton 5/2/2008 pdf file)

The Justice Department is investigating four cases of alleged selective prosecution, including the prosecution and overturned conviction of Wisconsin government official Georgia Thompson by former US Attorney Steven Biskupic (see April 5, 2007). The department’s Office of Professional Responsibility (OPR) informs the House Judiciary Committee of the investigations, in a letter signed by OPR chief H. Marshall Jarrett. Since Thompson’s conviction was overturned over a year ago, her prosecution has been widely criticized as giving the appearance of being politically motivated (see April 7-10, 2007, April 16, 2007, and April 24, 2007). Committee members John Conyers (D-MI), Tammy Baldwin (D-WI), and Linda Sanchez (D-CA) are spearheading the committee’s probe into the Thompson prosecution. Many suspect that Biskupic prosecuted Thompson in order to avoid being fired in the 2006 US Attorney purge (see March 10, 2006, December 7, 2006, and December 20, 2006). Biskupic has denied knowing he was being considered for termination before he opened his prosecution of Thompson (see March 2, 2005), though he has also admitted to learning about being on the “purge” list after the fact (see April 14, 2007). John Dingell.John Dingell. [Source: MSNBC]Democratic representatives Rosa DeLauro (D-CT) and John Dingell (D-MI) write a letter to Federal Communications Commission (FCC) chairman Kevin J. Martin, urging that his agency begin an immediate investigation of the Pentagon’s recently revealed propaganda operation (see April 20, 2008 and Early 2002 and Beyond). DeLauro has already written requests for explanations to five different networks, and has received only two responses (see May 2, 2008 and April 29, 2008). DeLauro and Dingell want to know whether the operation violated the Communications Act of 1934 and/or FCC rules, particularly the sponsorship identification requirements. “While we deem the DoD’s [Defense Department’s] policy unethical and perhaps illegal,” they write, “we also question whether the analysts and the networks are potentially equally culpable pursuant to the sponsorship identification requirements in the Communications Act of 1934… and the rules of the Federal Communications Commission.… It could appear that some of these analysts were indirectly paid for fostering the Pentagon’s views on these critical issues. Our chief concern is that as a result of the analysts’ participation in this [Defense Department] program, which included the [Defense Department]‘s paying for their commercial airfare on [Defense Department]-sponsored trips to Iraq, the analysts and the networks that hired them could have run afoul of certain laws or regulations.” DeLauro and Dingell conclude: “When seemingly objective television commentators are in fact highly motivated to promote the agenda of a government agency, a gross violation of the public trust occurs. The American people should never be subject to a covert propaganda campaign but rather should be clearly notified of who is sponsoring what they are watching.” (US House of Representatives 5/6/2008)

Michael J. Copps.Michael J. Copps. [Source: Cable's Leaders in Learning (.org)]The Pentagon’s propaganda operation—using military analysts in media outlets to promote the administration’s policies in Iraq (see Early 2002 and Beyond), as recently revealed in the New York Times (see April 20, 2008)—draws a sharp reaction from Federal Communications Commission (FCC) Commissioner Michael J. Copps. Copps, a Democrat, applauds the efforts of Democratic lawmakers and political bloggers to keep pushing for accountability (see May 8, 2008), saying: “President Eisenhower warned against the excesses of a military-industrial complex. I’d like to think that hasn’t morphed into a military-industrial-media complex, but reports of spinning the news through a program of favored insiders don’t inspire a lot of confidence.” The propaganda operation was “created in order to give military analysts access in exchange for positive coverage of the Iraq war,” Copps adds. The Pentagon posts the more than 8,000 pages of documents, transcripts, and audio tapes it was forced to release to the New York Times as evidence of its ongoing propaganda campaign to manipulate public opinion concerning Iraq (see April 20, 2008 and Early 2002 and Beyond). The only explanation given on the Web site is, “These documents were released to the New York Times regarding the Pentagon’s Military Analyst program.” (Staff 5/9/2008)

An editorial from the St. Petersburg Times rails against the recently revealed Pentagon propaganda operation that uses retired military officers to promote the administration’s policies in Iraq (see April 20, 2008 and Early 2002 and Beyond). “We were duped,” the editorial begins, and calls the Pentagon program a “spin operation.” The retired military officers serving as network analysts “are not as independent or as objective as they are portrayed,” the editorial continues. “They are feeding the public the Bush administration line just as they have been encouraged to do. The shilling then bought them plum access to the Pentagon that could be traded on later, giving them a leg up in securing large military contracts for their companies and clients.” The editorial calls the networks and cable news outlets that hired and televised these analysts “enablers in this propaganda campaign,” and lambasts them for not bothering to investigate their analysts’ connections to either the Defense Department or to defense contractors with vested interests in Iraq: “These former military officers were unlikely to give a fair reading of the war in Iraq when their corporate clients were paying huge sums for friendly Pentagon access so they could win business off the war.” (St. Petersburg Times 5/12/2008)

Washington Post political reporter and columnist Dan Froomkin, in an online chat with Post readers, gets the following question: “It looks like the Pentagon may have been behind ‘planting’ retired officers as analysts for news outlets (see April 20, 2008 and Early 2002 and Beyond). Do you think this can be tied to the White House? Is their any evidence of White House involvement?” Froomkin responds, “There’s no question at all that the Pentagon organized it. As for White House involvement, that’s a very good question. There’s no hard evidence thus far, but I’m not sure anyone’s really digging for it—and it’s hard to imagine they weren’t plugged in to some extent.” (Froomkin 5/14/2008)

William Odom.William Odom. [Source: Brendan Smialowski / Bloomberg News]Retired Lieutenant General William Odom, former director of the National Security Agency (NSA) under Ronald Reagan, says that he is “shocked” by the revelations of a propaganda campaign mounted by the Pentagon to manipulate public opinion regarding Iraq (see April 20, 2008 and Early 2002 and Beyond). Odom says: “Well, I was a little shocked by it.… My own sense of my obligations and my officer’s honor in the past would make me think that’s not a proper thing to do.… But I don’t think they’ll be able to defend that position publicly very well, particularly because of its sort of conspiratorial nature. I think it’s quite legitimate for military officers to talk to a number of people in the Pentagon, but to be part of a recurring meeting that is designed to shape the public opinion—that’s a strange thing for officers to be willing to do, in my view.” (WAMU-FM American University 5/19/2008; Think Progress 5/19/2008)

The House passes an amendment to the 2009 Defense Authorization Bill; the amendment, written by Representative Paul Hodes (D-NH), will, if it becomes law, prohibit the Pentagon from engaging in propaganda programs like the one revealed by the New York Times (see April 20, 2008 and Early 2002 and Beyond). The amendment also requires the Government Accountability Office (GAO) to launch an investigation of the Pentagon’s propaganda program. Hodes says on the floor of the House: “In a free and democratic society, our government should never use the public airwaves to propagandize our citizens. Congress cannot allow an administration to manipulate the public with false propaganda on matters of war and our national security.… This amendment will ensure that no money authorized in this act will be used for a propaganda program, and require a report to Congress by both the Defense Inspector General and the Government Accountability Office on whether previous restrictions on propaganda have been violated. It’s time for the American people to finally know the truth.” (US House of Representatives 5/22/2008)

Henry Waxman (D-CA), the chairman of the House Oversight Committee, writes to Attorney General Michael Mukasey requesting access to the transcripts of interviews by President Bush and Vice President Cheney regarding the “outing” of CIA agent Valerie Plame Wilson (see Shortly after February 13, 2002). The interviews were conducted as part of the investigation of former Vice Presidential Chief of Staff Lewis “Scooter” Libby by special prosecutor Patrick Fitzgerald. Waxman notes that he made a similar request in December 2007 which has gone unfulfilled (see December 3, 2007). Waxman wants the reports from Bush and Cheney’s interviews, and the unredacted reports from the interviews with Libby, former White House Deputy Chief of Staff Karl Rove, former White House press secretary Scott McClellan, former National Security Adviser Condoleezza Rice, former White House aide Cathie Martin, “and other senior White House officials.” Information revealed by McClellan in conjuction with his new book What Happened, including McClellan’s statement that Bush and Cheney “directed me to go out there and exonerate Scooter Libby,” and his assertion that “Rove, Libby, and possibly Vice President Cheney… allowed me, even encouraged me, to repeat a lie,” adds to evidence from Libby’s interviews that Cheney may have been the source of the information that Wilson worked for the CIA. For Cheney to leak Wilson’s identity, and to then direct McClellan to mislead the public, “would be a major breach of trust,” Waxman writes. He adds that no argument can be made for withholding the documents on the basis of executive privilege, and notes that in 1997 and 1998, the Oversight Committee demanded and received FBI interviews with then-President Clinton and then-Vice President Gore without even consulting the White House. The Senate Intelligence Committee releases its long-awaited “Phase II” report on the Bush administration’s use of intelligence in convincing the country that it was necessary to invade Iraq. According to the report, none of the claims made by the administration—particularly that Iraq had WMD and that its government had working ties with Islamist terror organizations such as al-Qaeda—were based in any intelligence reporting. The committee released “Phase I” of its report in July 2004, covering the quality of intelligence used in making the case for war; the second phase was promised “soon afterwards” by the then-Republican leadership of the committee, but nothing was done until after Democrats took over the committee in November 2006. The report is the product of what the Associated Press calls “nasty partisan fight[ing]” among Republicans and Democrats, and largely fails to reveal much information that has not earlier been reported elsewhere. (Hess 6/5/2008) The report is bipartisan in that two Republican committee members, Olympia Snowe (R-ME) and Chuck Hagel (R-NE), joined the committee’s Democrats to sign the report. (Rushing 6/5/2008)
False Linkages between Iraq, Al-Qaeda - Time magazine notes that the report “doesn’t break any new ground,” but tries “to make the case that President Bush and his advisers deliberately disregarded conflicting intel and misled Americans on the severity of the Iraqi threat.” Committee chairman John D. Rockefeller (D-WV) says: “It is my belief that the Bush administration was fixated on Iraq, and used the 9/11 attacks by al-Qaeda as justification for overthrowing Saddam Hussein. To accomplish this, top administration officials made repeated statements that falsely linked Iraq and al-Qaeda as a single threat.” (Cruz 6/6/2008)
Examination of Five Speeches - The report looks at the statements of current and former Bush administration officials such as President Bush, Vice President Cheney, Secretary of State Colin Powell, and Defense Secretary Donald Rumsfeld, between October 2002 and the actual invasion of Iraq in March 2003 (see January 23, 2008), largely focusing on five speeches:
bullet Cheney’s speech to the Veterans of Foreign Wars National Convention (see August 26, 2002);
bullet Bush’s statement to the UN General Assembly (see September 12, 2002);
bullet Bush’s speech in Cincinnati (see October 7, 2002);
bullet Bush’s State of the Union speech (see 9:01 pm January 28, 2003);
bullet and Powell’s presentation to the United Nations Security Council (see February 5, 2003).
The report contrasts these speeches and statements to intelligence reports that have since then been released. The report only assesses the veracity of public comments made by Bush officials, and does not delve into any possible behind-the-scenes machinations by those officials or their surrogates. Some of the report’s conclusions:
bullet “Statements which indicated that [Saddam] Hussein was prepared to give WMDs to terrorists were inconsistent with existing intelligence at the time, as were statements that suggested a partnership between the two.”
bullet “Claims that airstrikes on their own would not be sufficient to destroy purported chemical and biological weapons in Iraq were unsubstantiated.”
bullet “Most statements that supported the theory that Hussein had access to or the capacity to build chemical, biological, or even nuclear weapons did not take into account the disagreements between intelligence agencies as to the credibility of the WMD allegations.”
'Statements beyond What the Intelligence Supported' - Rockefeller says the administration concealed information that contradicted their arguments that an invasion was necessary. “We might have avoided this catastrophe,” he says. The report finds that while many of the administration’s claims were supported by at least some intelligence findings, the administration routinely refused to mention dissents or uncertainties expressed by intelligence analysts about the information being presented. The committee’s five Republicans assail the report as little more than election-year partisanship, and accuse Democrats of using the report to cover for their own members, including Rockefeller and Carl Levin (D-MI), who supported the administration’s push for war at the time. (Senate Intelligence Committee 6/5/2008 pdf file; Hess 6/5/2008; Cruz 6/6/2008) Rockefeller answers the Republican charges by saying, “[T]here is a fundamental difference between relying on incorrect intelligence and deliberately painting a picture to the American people that you know is not fully accurate.” Committee member Dianne Feinstein (D-CA) writes in a note attached to the report: “Even though the intelligence before the war supported inaccurate statements, this administration distorted the intelligence in order to build its case to go to war. The executive branch released only those findings that supported the argument, did not relay uncertainties, and at times made statements beyond what the intelligence supported.” (Walls 6/5/2008)

The recently released Senate Intelligence Committee report on misleading, exaggerated, and inaccurate presentations of the prewar Iraqi threat by the Bush administration (see June 5, 2008) leaves out some significant material. The report says that the panel did not review “less formal communications between intelligence agencies and other parts of the executive branch.” The committee made no attempt to obtain White House records or interview administration officials because, the report says, such steps were considered beyond the scope of the report. Washington Post reporter Walter Pincus notes that “[o]ne obvious target for such an expanded inquiry would have been the records of the White House Iraq Group (WHIG), a group set up in August 2002 by then-White House Chief of Staff Andrew H. Card Jr.” WHIG (see August 2002) was composed of, among other senior White House officials, senior political adviser Karl Rove; the vice president’s chief of staff, Lewis “Scooter” Libby; communications strategists Karen Hughes, Mary Matalin, and James Wilkinson; legislative liaison Nicholas Calio; and a number of policy aides led by National Security Adviser Condoleezza Rice and her deputy, Stephen Hadley.
WHIG Led Marketing of War - Scott McClellan, the former White House press secretary, recently wrote in his book What Happened that WHIG “had been set up in the summer of 2002 to coordinate the marketing of the war to the public.… The script had been finalized with great care over the summer [for a] “campaign to convince Americans that war with Iraq was inevitable and necessary.” On September 6, 2002, Card hinted as much to reporters when he said, “From a marketing point of view, you don’t introduce new products in August” (see September 6, 2002). Two days later, the group scored its first hit with a front-page New York Times story about Iraq’s secret purchase of aluminum tubes that, the story said, could be used to produce nuclear weapons (see September 8, 2002). The information for that story came from “senior administration officials” now known to be members of WHIG. The story was the first to make the statement that “the first sign of a ‘smoking gun’ [proving the existence of an Iraqi nuclear weapons program] may be a mushroom cloud” (see September 4, 2002); that same morning, the same message was repeated three times by various senior administration officials on the Sunday talk shows (see September 8, 2002, September 8, 2002, and September 8, 2002). WHIG did not “deliberately mislead the public,” McClellan claimed in his book, but wrote that the “more fundamental problem was the way [Bush’s] advisers decided to pursue a political propaganda campaign to sell the war to the American people.… As the campaign accelerated,” caveats and qualifications were downplayed or dropped altogether. Contradictory intelligence was largely ignored or simply disregarded.”
Records Perusal Would 'Shed Light' - If indeed the White House “repeatedly presented intelligence as fact when it was unsubstantiated, contradicted, or even nonexistent,” as committee chairman John D. Rockefeller (D-WV) has said, then an examination of WHIG’s records would, Pincus writes, “shed much light” on the question. (Pincus 6/9/2008)

He is joined by Justice Department lawyer John Yoo, who authored or contributed to many of the legal opinions that the administration used to justify the torture and “extralegal” treatment of terror suspects (see November 6-10, 2001). Addington, unwillingly responding to a subpoena, is, in Washington Post reporter Dana Milbank’s description, “nasty, brutish, and short” with his questioners. (Milbank 6/27/2008) He tells lawmakers that the world has not changed much since the 9/11 attacks: “Things are not so different today as people think. No American should think we are free, the war is over, al-Qaeda is not coming.” (Barnes 6/27/2008)
Refusing to Define 'Unitary Executive' - Committee chairman John Conyers (D-MI) peppers Addington with questions about the Bush administration and its penchant for the “unitary executive” paradigm, which in essence sees the executive branch as separate and above the other two, “lesser” branches of government. Addington is one of the main proponents of this theory (see (After 10:00 a.m.) September 11, 2001). But instead of answering Conyers’s questions, he slaps away the questions with what Milbank calls “disdain.”

Open Contempt - He flatly refuses to answer most questions, and treats the representatives who ask him those questions with open contempt and, in Milbank’s words, “unbridled hostility.” One representative asks if the president is ever justified in breaking the law, and Addington retorts, “I’m not going to answer a legal opinion on every imaginable set of facts any human being could think of.” When asked if he consulted Congress when interpreting torture laws, Addington snaps: “That’s irrelevant.… There is no reason their opinion on that would be relevant.” Asked if it would be legal to torture a detainee’s child (see After September 11, 2002), Addington answers: “I’m not here to render legal advice to your committee. You do have attorneys of your own.” He offers to give one questioner advice on asking better questions. When asked about an interrogation session he had witnessed at Guantanamo, he replies: “You could look and see mouths moving. I infer that there was communication going on.” At times he completely ignores questions, instead writing notes to himself while the representatives wait for him to take notice of their queries. At other times, he claims an almost complete failure of memory, particularly regarding conversations he had with other Bush officials about interrogation techniques. (Milbank 6/27/2008) (He does admit to being briefed by Yoo about an August 2002 torture memo (see August 1, 2002), but denies assisting Yoo in writing it.) (Barnes 6/27/2008) Addington refuses to talk more specifically about torture and interrogation practices, telling one legislator that he can’t speak to him or his colleagues “[b]ecause you kind of communicate with al-Qaeda.” He continues, “If you do—I can’t talk to you, al-Qaeda may watch C-SPAN.” When asked if he would meet privately to discuss classified matters, he demurs, saying instead: “You have my number. If you issue a subpoena, we’ll go through this again.” (Khanna 6/26/2008; Milbank 6/27/2008)
Yoo Dodges, Invokes Privilege - Milbank writes that Yoo seems “embolden[ed]” by Addington’s “insolence.” Yoo engages in linguistic gymnastics similar to Addington’s discussion with Conyers when Keith Ellison (D-MN) asks him whether a torture memo was implemented. “What do you mean by ‘implemented’?” Yoo asks. Ellison responds, “Mr. Yoo, are you denying knowledge of what the word ‘implement’ means?” Yoo says, “You’re asking me to define what you mean by the word?” Ellison, clearly exasperated, retorts, “No, I’m asking you to define what you mean by the word ‘implement.’” Yoo’s final answer: “It can mean a wide number of things.” (Milbank 6/27/2008) Conyers asks Yoo, “Could the president order a suspect buried alive?” Yoo responds, “Uh, Mr. Chairman, I don’t think I’ve ever given advice that the president could order someone buried alive.” Conyers retorts: “I didn’t ask you if you ever gave him advice. I asked you thought the president could order a suspect buried alive.” Yoo answers, “Well Chairman, my view right now is that I don’t think a president—no American president would ever have to order that or feel it necessary to order that.” Conyers says, “I think we understand the games that are being played.” Reporter Christopher Kuttruff writes, “Throughout his testimony, Yoo struggled with many of the questions being asked, frequently delaying, qualifying and invoking claims of privilege to avoid answering altogether.” (Human Rights First 6/26/2008; Kuttruff 6/27/2008)

[Source: Mark Wilson / Getty Images]Steven Hatfill, who was called a “person of interest” in the FBI’s investigation into the 2001 anthrax attacks (see October 5-November 21, 2001), agrees to a $5.82 million payment from the government to settle his legal claim that the Justice Department and the FBI ruined his career and invaded his privacy. Hatfill was the main focus of the anthrax investigation for several years, but was never arrested or charged. A federal judge presiding over his lawsuit recently said there “is not a scintilla of evidence” linking him to the attacks. The government does not formally admit any wrongdoing as part of the settlement, but the payout is widely viewed as an exoneration for Hatfill. For instance, the Los Angeles Times calls Hatfill “all but exonerated.” No witnesses or physical evidence were ever produced to link Hatfill to the attacks. Representative Rush Holt (D-NJ) says the government’s payout to Hatfill confirms that the anthrax investigation “was botched from the very beginning.… The FBI did a poor job of collecting evidence, and then inappropriately focused on one individual as a suspect for too long, developing an erroneous ‘theory of the case’ that has led to this very expensive dead end.” (Willman 6/28/2008; Willman 6/29/2008)

In an interview with CNN, FBI Director Robert Mueller gives an upbeat assessment of the FBI’s investigation into the 2001 anthrax attacks (see October 5-November 21, 2001), despite the exoneration of Steven Hatfill, the only publicly named suspect, the month before (see June 27, 2008). Mueller says: “I’m confident in the course of the investigation.… And I’m confident that it will be resolved.… I tell you, we’ve made great progress in the investigation. It’s in no way dormant. It’s active.… In some sense there have been breakthroughs, yes.” (CNN 7/24/2008) Just days after these comments, Bruce Ivins, the FBI’s top unpublicized suspect at the time, will die of an apparent suicide (see July 29, 2008).

The Los Angeles Times is the first media outlet to report on his death three days later. The Times claims that Ivins died “just as the Justice Department was about to file criminal charges against him” for the 2001 anthrax attacks (see October 5-November 21, 2001). For the last 18 years, Ivins had worked at the United States Army Medical Research Institute of Infectious Diseases (USAMRIID), the US government’s top biological research laboratory at Fort Detrick, Maryland. His name had not been made public as a suspect in the case prior to his death. He dies at Frederick Memorial Hospital after ingesting a massive dose of prescription Tylenol mixed with codeine. Apparently there is no suicide note or any other known final message from Ivins. (Willman 8/1/2008) According to the Washington Post, Ivins had ingested the pills two or three days before he actually died. He was admitted to Frederick Memorial Hospital two days before his death. Investigators had scheduled a meeting with Ivins’s attorneys to discuss the evidence against him. However, Ivins dies two hours before the meeting is to take place (see July 29, 2008). (Johnson, Leonnig, and Wilber 8/2/2008) Apparently, no autopsy is performed on Ivins’s body. A Frederick Police Department lieutenant says that based on laboratory test results of blood taken from the body, the state medical examiner “determined that an autopsy wouldn’t be necessary” to confirm he died of a suicide. (Schmidt and Rowley 8/1/2008)

But many of Ivins’s colleagues at USAMRIID doubt that he was the killer.

bullet Also on August 2, Dr. Kenneth Hedlund, the former chief of bacteriology as USAMRIID, says, “He did not seem to have any particular grudges or idiosyncrasies.… He was the last person you would have suspected to be involved in something like this.” (Abruzzese and Lipton 8/2/2008) Three days later, Hedlund adds, “I think he’s a convenient fall guy. They can say, ‘OK, we found him, case closed, we’re going home. The FBI apparently applied a lot of pressure to all the investigators there, and they found the weakest link.” He also says that Ivins was a bacteriologist and lacked the expertise to convert the anthrax into the deadly form used in the 2001 attacks.

bullet Also on August 8, Melanie Ulrich, a USAMRIID scientist until 2007, says the FBI’s case against Ivins does not add up and their description of him does not match the person she worked with for six years. For instance, she said that shortly after 9/11, an intensive, all-encompassing psychological review was conducted of all USAMRIID employees with access to dangerous biological agents, and it does not make sense that some as supposedly as unstable as Ivins could have remained employed for years of such scrutiny. The FBI claims that an anthrax flask in Ivins’s custody was the “parent” of a certain anthrax strain, but Ulrich says different anthrax samples were genetically identical so any one sample can not be more of a “parent” than any other. The FBI suggests Ivins used a lyophilizer to make powdered anthrax, but Ulrich says Ivins signed out a SpeedVac, but not a lyophilizer, which is too large to fit in the secure protective area Ivins used at the time. Furthermore, a SpeedVac operates slowly and it would have been impossible for Ivins to use it to dry the amount of anthrax used in the letters in the time frame the FBI says he did. (Schotz 8/8/2008)
bullet On August 9, after the FBI has laid out its evidence against Ivins, Jeffrey Adamovicz, one of Ivins’s supervisors in USAMRIID’s bacteriology division, says, “I’d say the vast majority of people [at Fort Detrick] think he had nothing to do with it.” (Isikoff 8/9/2008) He also says that the anthrax sent to Sen. Tom Daschle (D-SD) was “so concentrated and so consistent and so clean that I would assert that Bruce could not have done that part.” (Gordon 8/7/2008)
bullet Former colleague Luann Battersby says Ivins was weird, but “not any weirder than a typical scientist.… He was not the weirdest by far I worked with down there.” She says that he was not a “strong person.… I would say he was milquetoast.… The fact that he was a terrorist doesn’t really square with my opinion with who he was.… I’m amazed at all this. I assume there’s evidence and that it’s true, but I certainly never would have suspected him.” She says she is unsure if he had the technical skills to commit the crime. (Heaney 8/10/2008)

The Justice Department formally clears Steven Hatfill of any involvement in the 2001 anthrax attacks (see October 5-November 21, 2001). The department sends a letter to Hatfill’s lawyer, stating: “We have concluded, based on lab access records, witness accounts, and other information, that Dr. Hatfill did not have access to the particular anthrax used in the attacks, and that he was not involved in the anthrax mailings.” (Popkin 8/8/2008) Hatfill won $5.8 million from the government in a settlement in June 2008, but the government admitted no wrongdoing and did not make any statement officially clearing him (see June 27, 2008).

Gerry Andrews, the chief of the bacteriology division at USAMRIID from 1999 to 2003, publishes an editorial in the New York Times. USAMRIID is the US Army’s top biological laboratory, and one of Andrew’s subordinates there was Bruce Ivins, the FBI’s main suspect in the 2001 anthrax attacks (see October 5-November 21, 2001) and also a friend of Andrews. Andrews says that the FBI’s recently revealed case against Ivins is unimpressive and lacks physical evidence. He states that the anthrax contained in a letter to Senator Tom Daschle (D-SD) was “a startlingly refined weapons-grade anthrax spore preparation, the likes of which had never been seen before by personnel at [USAMRIID]. It is extremely improbable that this type of preparation could ever have been produced [there], certainly not of the grade and quality found in that envelope.” Andrews also complains that the FBI has not provided “enough detail about their procedure to enable other scientists to tell whether they could actually single out Dr. Ivins’s spore preparation as the culprit…” (Andrews 8/9/2008)

Roger Ailes, a powerful Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988) and the founder and chairman of Fox News (see October 7, 1996), realizes that Senator Barack Obama (D-IL) is going to win the upcoming presidential election (see November 4, 2008). In preparation, Ailes begins hiring an array of conservatives to join his network (see November 3, 2003, July 2004, and October 26, 2009), many of whom he intends to groom for the 2012 presidential race. By the time the election is over, Ailes will have hired Karl Rove, the Bush administration’s political guru, and former Governor Mike Huckabee (R-AR), an unsuccessful Republican presidential candidate. (Ailes is able to woo both Rove and Huckabee away from CNN, which also offers them positions as paid commentators.) Soon, Ailes will hire several more possible Republican contenders, including the Republican vice-presidential candidate Sarah Palin (R-AK), former House Speaker Newt Gingrich (R-GA), former Senator Rick Santorum (R-PA), and former UN Ambassador John Bolton. Ailes fully intends to use Fox News as a platform for launching Republican presidential bids (see May 22, 2011), but his decision to hire Rove, Huckabee, Palin, and the others is also business-driven. A close friend of his will explain: “It would be easy to look at Fox and think it’s conservative because Rupert [Murdoch, the media executive who owns the Fox networks] and Roger are conservative and they program it the way they like. And to a degree, that’s true. But it’s also a business. And the way the business works is, they control conservative commentary the way ESPN controls the market for sports rights. If you have a league, you have a meeting with ESPN, you find out how much they’re willing to pay, and then everyone else agrees to pay the same amount if they want it.… It’s sort of the same at Fox. I was surprised at some of what was being paid until I processed it that way. If you’re ABC and you don’t have Newt Gingrich on a particular morning, you can put someone else on. But if you’re Fox, and Newt is moving and talking today, you got to have him. Otherwise, your people are like: ‘Where’s Newt? Why isn’t he on my channel?’” Ailes met secretly with Palin in September 2008, and will continue to court her for Fox after the campaign, even loaning her a private jet owned by Murdoch’s News Corporation. CNN will decline to offer her a position, and Ailes, through programming chief Bill Shine, will negotiate a three-year, $3 million deal to have Palin as a regular contributor and a host of prime-time specials. Amid all of this, Ailes does not want Fox News to be seen as an arm of the Republican Party (see December 2002 and October 11, 2009). (Sherman 5/22/2011) In 2010, the press will report that Fox News has “exclusive rights” to broadcast and interview four presumed 2012 Republican candidates, Palin, Gingrich, Huckabee, and Santorum (see September 27, 2010).

A former Air Force interrogator writing under the pseudonym “Matthew Alexander” pens an impassioned plea against the use of torture for the Washington Post. Alexander is a former Special Operations soldier with war experience in Bosnia and Kosovo before volunteering to serve as a senior interrogator in Iraq from February 2006 through August 2006. He writes that while he served in Iraq, his team “had successfully hunted down one of the most notorious mass murderers of our generation, Abu Musab al-Zarqawi, the leader of al-Qaeda in Iraq and the mastermind of the campaign of suicide bombings that had helped plunge Iraq into civil war.” Yet upon his return, Alexander writes that he was less inclined to celebrate American success than “consumed with the unfinished business of our mission: fixing the deeply flawed, ineffective and un-American way the US military conducts interrogations in Iraq.” Since then, Alexander has written a book, How to Break a Terrorist: The US Interrogators Who Used Brains, Not Brutality, to Take Down the Deadliest Man in Iraq (see December 2-4, 2008). He writes that interrogation techniques used against terror suspects in Iraq both “betrays our traditions” and “just doesn’t work.”
Army Used 'Guantanamo Model' of Interrogation - When he joined the team hunting for al-Zarqawi, he was astonished to find that “[t]he Army was still conducting interrogations according to the Guantanamo Bay model: Interrogators were nominally using the methods outlined in the US Army Field Manual, the interrogators’ bible, but they were pushing in every way possible to bend the rules—and often break them.… These interrogations were based on fear and control; they often resulted in torture and abuse.”
New and Different Methodology - Alexander refused to allow his interrogators to use such tactics, he writes, and instead taught them a new set of practices: “one based on building rapport with suspects, showing cultural understanding and using good old-fashioned brainpower to tease out information. I personally conducted more than 300 interrogations, and I supervised more than 1,000. The methods my team used are not classified (they’re listed in the unclassified Field Manual), but the way we used them was, I like to think, unique. We got to know our enemies, we learned to negotiate with them, and we adapted criminal investigative techniques to our work (something that the Field Manual permits, under the concept of ‘ruses and trickery’). It worked. Our efforts started a chain of successes that ultimately led to Zarqawi.” Alexander writes that his attitude, and that of his colleagues, changed during this time. “We no longer saw our prisoners as the stereotypical al-Qaeda evildoers we had been repeatedly briefed to expect; we saw them as Sunni Iraqis, often family men protecting themselves from Shi’ite militias and trying to ensure that their fellow Sunnis would still have some access to wealth and power in the new Iraq. Most surprisingly, they turned out to despise al-Qaeda in Iraq as much as they despised us, but Zarqawi and his thugs were willing to provide them with arms and money.” When Alexander pointed this out to General George Casey, then the top US commander in Iraq, Casey ignored him. Alexander writes that Casey’s successor, General David Petraeus, used some of the same “rapport-building” techniques to help boost the “Anbar Awakening,” which saw tens of thousands of Sunnis repudiate al-Zarqawi and align themselves with the US. And, the techniques persuaded one of al-Zarqawi’s associates to tell where he was hiding, giving the US a chance to find and kill him (see June 8, 2006).
Little Overall Change - Even the success in locating and killing al-Zarqawi had little effect on US interrogation methods outside of Alexander’s unit. He left Iraq still unsettled about the methods being used; shortly after his return, he was horrified at news reports that the CIA had waterboarded detainees to coerce information from them (see Between May and Late 2006). Such hard-handed techniques are not only illegal and morally reprehensible, Alexander notes, they usually don’t work. He writes: “Torture and abuse are against my moral fabric. The cliche still bears repeating: Such outrages are inconsistent with American principles. And then there’s the pragmatic side: Torture and abuse cost American lives.” He remembers one jihadist who told him: “I thought you would torture me, and when you didn’t, I decided that everything I was told about Americans was wrong. That’s why I decided to cooperate.”
Torture Breeds Terrorism - Alexander writes that while in Iraq, he learned that the primary reason foreign jihadists came to Iraq to fight Americans was because of their outrage and anger over the abuses carried out at Guantanamo and Abu Ghraib. “Our policy of torture was directly and swiftly recruiting fighters for al-Qaeda in Iraq,” he writes. “The large majority of suicide bombings in Iraq are still carried out by these foreigners. They are also involved in most of the attacks on US and coalition forces in Iraq. It’s no exaggeration to say that at least half of our losses and casualties in that country have come at the hands of foreigners who joined the fray because of our program of detainee abuse. The number of US soldiers who have died because of our torture policy will never be definitively known, but it is fair to say that it is close to the number of lives lost on Sept. 11, 2001. How anyone can say that torture keeps Americans safe is beyond me—unless you don’t count American soldiers as Americans.”
Writing about His Experiences - Alexander began writing about his time in Iraq after returning to the US. When he submitted his book for the Defense Department’s review (standard procedure to ensure no classified information is being released), he writes that he “got a nasty shock.” The Pentagon delayed the review past the first scheduled printing date, then redacted what Alexander says was “an extraordinary amount of unclassified material—including passages copied verbatim from the Army’s unclassified Field Manual on interrogations and material vibrantly displayed on the Army’s own Web site.” Alexander was forced to file a lawsuit to get the review completed and to appeal the redactions. “Apparently, some members of the military command are not only unconvinced by the arguments against torture; they don’t even want the public to hear them.”
Conclusions - How we conduct ourselves in the “war on terror” helps define who we are as Americans, Alexander writes. “Murderers like Zarqawi can kill us, but they can’t force us to change who we are. We can only do that to ourselves.” It is up to Americans, including military officers directly involved in the battle against terrorist foes, “to protect our values not only from al-Qaeda but also from those within our own country who would erode them.” He continues: “We’re told that our only options are to persist in carrying out torture or to face another terrorist attack. But there truly is a better way to carry out interrogations—and a way to get out of this false choice between torture and terror.” With the ascension of Barack Obama to the White House, Alexander describes himself as “quite optimistic” that the US will renounce torture. “But until we renounce the sorts of abuses that have stained our national honor, al-Qaeda will be winning. Zarqawi is dead, but he has still forced us to show the world that we do not adhere to the principles we say we cherish. We’re better than that. We’re smarter, too.” (Alexander 11/30/2008)

In a lengthy interview, terminally ill columnist Robert Novak says he would reveal the covert identity of former CIA official Valerie Plame Wilson again (see July 14, 2003), both because he feels he caused Plame Wilson no damage and because of his own personal desire for retribution against his critics. Novak says that while he expressed some “ambivalence” about his outing of Plame Wilson in his 2007 autobiography The Prince of Darkness, “Now I’m much less ambivalent. I’d go full speed ahead because of the hateful and beastly way in which my left-wing critics in the press and Congress tried to make a political affair out of it and tried to ruin me. My response now is this: The hell with you. They didn’t ruin me. I have my faith, my family, and a good life. A lot of people love me—or like me. So they failed. I would do the same thing over again because I don’t think I hurt Valerie Plame [Wilson] whatsoever.” (Matusow 12/1/2008) Not only did Novak’s revelation of Plame Wilson’s identity do serious damage to the US intelligence community’s ability to learn of potential threats (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, and February 13, 2006), Plame Wilson has written that she feared for the lives of herself and her family after Novak’s outing (see July 14, 2003).

In a speech at the Saban Center for Middle East Policy in Washington, outgoing President Bush discusses his decision to invade Iraq. “It is true, as I have said many times, that Saddam Hussein was not connected to the 9/11 attacks,” he says. “But the decision to remove Saddam from power cannot be viewed in isolation from 9/11. In a world where terrorists armed with box cutters had just killed nearly 3,000 people, America had to decide whether we could tolerate a sworn enemy that acted belligerently, that supported terror, and that intelligence agencies around the world believed had weapons of mass destruction. It was clear to me, to members of both political parties, and to many leaders around the world that after 9/11, this was a risk we could not afford to take. So we went back to the UN Security Council, which unanimously passed Resolution 1441 calling on Saddam Hussein to disclose, disarm, or face serious consequences (see November 8, 2002). With this resolution, we offered Saddam Hussein a final chance to comply with the demands of the world. When he refused to resolve the issue peacefully, we acted with a coalition of nations to protect our people and liberated 25 million Iraqis.” Amanda Terkel, a writer for the liberal website Think Progress, notes that all of Bush’s acknowledgments that Iraq had no connections to 9/11 came after the war began; in the months prior to the invasion, Bush and his top officials strove to create the impression that Hussein had close links to al-Qaeda and the 9/11 planners (see (Between 10:30 a.m. and 12:00 p.m.) September 11, 2001, Shortly After September 11, 2001, Shortly After September 11, 2001, After September 11, 2001, Mid-September, 2001, September 17, 2001, September 19, 2001, September 20, 2001, September 28, 2001, November 6-8, 2001, December 9, 2001, 2002-March 2003, March 19, 2002, June 21, 2002, July 25, 2002, August 2002, August 20, 2002, September 12, 2002, September 16, 2002, September 21, 2002, September 25, 2002, September 26, 2002, September 27, 2002, September 28, 2002, October 7, 2002, October 7, 2002, October 15, 2002, December 2, 2002, December 12, 2002, January 26, 2003, January 28, 2003, Early February 2003, February 5, 2003, (2:30 a.m.-9:00 a.m.) February 5, 2003, February 5, 2003, February 6, 2003, February 11 or 12, 2003, and February 17, 2003). Terkel writes, “Bush still embraces his pre-war lies, as he admitted in his Saban address today, because without them, the public wouldn’t have supported his case for war.” (Carney 12/5/2008; Terkel 12/5/2008)

The Senate Armed Services Committee releases a classified 261-page report on the use of “harsh” or “enhanced interrogation techniques”—torture—against suspected terrorists by the US. The conclusion of the report will be released in April 2009 (see April 21, 2009). The report will become known as the “Levin Report” after committee chairman Carl Levin (D-MI). Though the report itself is classified, the committee releases the executive summary to the public.
Top Bush Officials Responsible for Torture - One of the report’s findings is that top Bush administration officials, and not a “few bad apples,” as many of that administration’s officials have claimed, are responsible for the use of torture against detainees in Guantanamo, Afghanistan, Iraq, and elsewhere.
Began Shortly after 9/11 - The report finds that US officials began preparing to use “enhanced interrogation” techniques just a few months after the 9/11 attacks, and well before Justice Department memos declared such practices legal. The program used techniques practiced in a US military program called Survival, Evasion, Resistance, and Escape (SERE—see December 2001), which trains US military personnel to resist questioning by foes who do not follow international bans on torture. As part of SERE training, soldiers are stripped naked, slapped, and waterboarded, among other techniques. These techniques were “reverse-engineered” and used against prisoners in US custody. Other techniques used against prisoners included “religious disgrace” and “invasion of space by a female.” At least one suspected terrorist was forced “to bark and perform dog tricks” while another was “forced to wear a dog collar and perform dog tricks” in a bid to break down their resistance.
Tried to 'Prove' Links between Saddam, Al-Qaeda - Some of the torture techniques were used before the March 2003 invasion of Iraq (see March 19, 2003). Much of the torture of prisoners, the report finds, was to elicit information “proving” alleged links between al-Qaeda and the regime of Saddam Hussein. US Army psychiatrist Major Paul Burney says of some Guantanamo Bay interrogations: “Even though they were giving information and some of it was useful, while we were there a large part of the time we were focused on trying to establish a link between al-Qaeda and Iraq. We were not being successful in establishing a link between al-Qaeda and Iraq. The more frustrated people got in not being able to establish this link… there was more and more pressure to resort to measures that might produce more immediate results.” Others did not mention such pressure, according to the report. (Senate Armed Services Committee 12/11/2008 pdf file; Agence France-Presse 4/21/2009) (Note: Some press reports identify the quoted psychiatrist as Major Charles Burney.) (Landay 4/21/2009) A former senior intelligence official later says: “There were two reasons why these interrogations were so persistent, and why extreme methods were used. The main one is that everyone was worried about some kind of follow-up attack [after 9/11]. But for most of 2002 and into 2003, Cheney and Rumsfeld, especially, were also demanding proof of the links between al-Qaeda and Iraq that [former Iraqi exile leader Ahmed] Chalabi (see November 6-8, 2001) and others had told them were there.… There was constant pressure on the intelligence agencies and the interrogators to do whatever it took to get that information out of the detainees, especially the few high-value ones we had, and when people kept coming up empty, they were told by Cheney’s and Rumsfeld’s people to push harder.” (Landay 4/21/2009)
Warnings of Unreliability from Outset - Almost from the outset of the torture program, military and other experts warned that such techniques were likely to provide “less reliable” intelligence results than traditional, less aggressive approaches. In July 2002, a memo from the Joint Personnel Recovery Agency (JRPA), which oversees the SERE training program, warned that “if an interrogator produces information that resulted from the application of physical and psychological duress, the reliability and accuracy of this information is in doubt. In other words, a subject in extreme pain may provide an answer, any answer, or many answers in order to get the pain to stop” (see July 2002). Ignoring Military Objections - When Pentagon general counsel William Haynes asked Defense Secretary Donald Rumsfeld to approve 15 of 18 recommended torture techniques for use at Guantanamo (see December 2, 2002), Haynes indicated that he had discussed the matter with three officials who agreed with him: Deputy Defense Secretary Paul Wolfowitz, Undersecretary of Defense Douglas Feith, and General Richard Myers. Haynes only consulted one legal opinion, which senior military advisers had termed “legally insufficient” and “woefully inadequate.” Rumsfeld agreed to recommend the use of the tactics. As one of his first official acts as president, Barack Obama orders that all military prosecutions of terrorist suspects at the Guantanamo Bay detention facility be suspended for 120 days. The order comes during the inaugural ceremonies, and is issued by Defense Secretary Robert Gates, the only Cabinet holdover from the Bush administration. “In the interests of justice, and at the direction of the president of the United States and the secretary of defense, the government respectfully requests the military commission grant a continuance of the proceedings in the above-captioned case until 20 May 2009,” the request reads. (CNN 1/21/2009; Agence France-Presse 1/21/2009) Obama promised repeatedly during and after the presidential campaign that he would close the detention facility at the Guantanamo Naval Base. This request does not go that far, but it does bring to a halt the planned prosecution of 21 detainees currently facing war crimes charges, including 9/11 plotter Khalid Shaikh Mohammed. Jamil Dakwar, a representative for the American Civil Liberties Union (ACLU) at the base, calls the request “a good step in the right direction.” Gabor Rona, an observer for Human Rights Watch, also calls the order “a first step.” Rona continues, “The very fact that it’s one of his first acts reflects a sense of urgency that the US cannot afford one more day of counterproductive and illegal proceedings in the fight against terrorism.” Dakwar says the ACLU believes all charges against the prisoners should be dropped. “A shutdown of this discredited system is warranted,” he says. “The president’s order leaves open the option of this discredited system remaining in existence.” Major Jon Jackson, the lawyer for one of the 9/11 defendants, Mustafa Ahmed al-Hawsawi (see Early-Late June, 2001 and September 24, 2001-December 26, 2002), says, “We welcome our new commander in chief and this first step towards restoring the rule of law.” Approximately 245 detainees are currently housed at the camp; some 60 detainees have been cleared for release, but no country has agreed to take them. (CNN 1/21/2009; Finn 1/21/2009) Michele Cercone, spokesman for the European Union Justice and Home Affairs Commission, says the commission “has been very pleased that one of the first actions of Mr. Obama has been to turn the page on this sad episode of Guantanamo.” The request is accepted the day after (see January 21, 2009), and the Los Angeles Times writes that it “may be the beginning of the end for the Bush administration’s system of trying alleged terrorists.” (Associated Press 1/21/2009)

President Barack Obama signs a series of executive orders mandating the closure of the Guantanamo Bay detention facility within one year’s time, and declares that prisoners at that facility will be treated within the parameters of the Geneva Conventions. Obama’s order also mandates the closure of the CIA’s secret prisons overseas. Another element of those orders bans the practice of torture on detainees (see January 22, 2009). Obama calls the order the first move by his administration to reclaim “the moral high ground” vacated by the previous administration. Americans understand that battling terrorism cannot continue with a “false choice between our safety and our ideals,” he says. (Los Angeles Times 1/23/2009; Priest 1/23/2009) “We can no longer afford drift, and we can no longer afford delay, nor can we cede ground to those who seek destruction,” he adds. (Raum and Elliott 1/22/2009) “We believe we can abide by a rule that says, we don’t torture, but we can effectively obtain the intelligence we need.” (Shane, Mazzetti, and Cooper 1/23/2009) The Washington Post reports that the orders essentially end the “war on terror” as it has been managed by the Bush administration, and writes, “[T]he notion that a president can circumvent long-standing US laws simply by declaring war was halted by executive order in the Oval Office.” However, Obama’s order does not detail what should be done with the detainees currently housed at Guantanamo. According to a White House summary, Obama’s orders “set… up an immediate review to determine whether it is possible to transfer detainees to third countries, consistent with national security.” If a prisoner cannot be transferred, “a second review will determine whether prosecution is possible and in what forum.” Obama says, “The message that we are sending the world is that the United States intends to prosecute the ongoing struggle against violence and terrorism and we are going to do so vigilantly and we are going to do so effectively and we are going to do so in a manner that is consistent with our values and our ideals.” The US will now “observe core standards of conduct, not just when it’s easy, but also when it’s hard,” he adds. The orders do not specifically ban the practice of “rendition,” or secretly transferring prisoners to the custody of other nations, some of which practice torture. “There are some renditions that are, in fact, justifiable, defensible,” says a senior Obama administration official. “There’s not going to be rendition to any country that engages in torture.”
Republicans, Conservatives Object - Representative Peter Hoekstra (R-MI), a supporter of torture by the Bush administration, says Obama’s orders are imprecise and vague: “This is an executive order that places hope ahead of reality—it sets an objective without a plan to get there.” (Los Angeles Times 1/23/2009; Priest 1/23/2009) “What do we do with confessed 9/11 mastermind Khalid Shaikh Mohammed and his fellow terrorist conspirators.” Hoekstra asks, “offer them jail cells in American communities?” (Sevastopulo 1/22/2009) Conservative news outlet Fox News tells its viewers, “The National Security Council told Fox that for now even [O]sama bin Laden or a high-ranking terrorist planner would be shielded from aggressive interrogation techniques that the CIA says produced lifesaving intelligence from… Mohammed.” (US News and World Report 1/23/2009)
'A New Era for America' - Newly installed Secretary of State Hillary Clinton has a different view. “I believe with all my heart that this is a new era for America,” she tells reporters as she assumes her duties at the State Department. (Collinson 1/22/2009) Former Bush official John Bellinger, the National Security Council’s top legal adviser, praises Obama’s orders, calling them “measured” and noting that they “do not take any rash actions.” Bellinger adds: “Although the Gitmo order is primarily symbolic, it is very important. It accomplishes what we could never accomplish during the Bush administration.” (Shane, Mazzetti, and Cooper 1/23/2009) Retired admiral John Hutson agrees. “It is a 180 degree turn,” says Hutson. “It restores our status in the world. It enables us to be proud of the way we are prosecuting the war.” Closing the Guantanamo prison camp and banning torture “is the right thing to do morally, diplomatically, militarily and constitutionally,” Hutson adds, “but it also makes us safer.” Senator John Kerry (D-MA) calls the move “a great day for the rule of law.” (Sevastopulo 1/22/2009; Shane, Mazzetti, and Cooper 1/23/2009)

Former Attorney General Alberto Gonzales tells an NPR reporter that he never allowed the Justice Department (DOJ) to become politicized, and that he believes the historical judgment of his tenure in the department will be favorable. He acknowledges making some errors, including failing to properly oversee the DOJ’s push to fire nine US attorneys in 2008, a process many believe was orchestrated by the White House with the involvement of Gonzales and then-White House political guru Karl Rove.
Failure to Engage - “No question, I should have been more engaged in that process,” he says, but adds that he is being held accountable for decisions made by his subordinates. “I deeply regret some of the decisions made by my staff,” he says, referring to his former deputy Paul McNulty, who resigned over the controversy after telling a Senate committee that the attorney firings were performance-related and not politically motivated. Gonzales says his then-chief of staff, Kyle Sampson, was primarily responsible for the US attorney review process and for working with McNulty. “If Paul McNulty makes a recommendation to me—if a recommendation includes his views—I would feel quite comfortable that those would be good recommendations coming to me” about the qualifications of the US attorneys under question, Gonzales says. He adds that he has “seen no evidence” that Rove or anyone at the White House tried to use the US attorneys to politicize the work at the DOJ. A review by the DOJ’s Inspector General found that the firing policy was fundamentally flawed, and that Gonzales was disengaged and had failed to properly supervise the review process.
Claims He Was Unfairly Targeted by 'Mean-Spirited' Washington Insiders - Gonzales says he has been unfairly held responsible for many controversial Bush administration policies, including its refusal to abide by the Geneva Conventions (see Late September 2001, January 9, 2002, January 18-25, 2002, January 25, 2002, August 1, 2002, November 11, 2004, and January 17, 2007) and its illegal eavesdropping on US citizens (see Early 2004, March 9, 2004, December 19, 2005, Early 2006, and February 15, 2006), because of his close personal relationship with former President Bush. Washington, he says, is a “difficult town, a mean-spirited town.” He continues: “Sometimes people identify someone to target. That’s what happened to me. I’m not whining. It comes with the job.”
Visiting Ashcroft at the Hospital - In 2004, Gonzales, then the White House counsel, and White House chief of staff Andrew Card raced to the bedside of hospitalized Attorney General John Ashcroft to persuade, or perhaps coerce, Ashcroft to sign off on a secret government surveillance program (see March 10-12, 2004). The intervention was blocked by Deputy Attorney General James Comey (see March 12-Mid-2004). Gonzales says he has no regrets about the incident: “Neither Andy nor I would have gone there to take advantage of somebody who was sick. We were sent there on behalf of the president of the United States.” As for threats by Justice Department officials to resign en masse over the hospital visit (see Late March, 2004), Gonzales merely says, “Lawyers often disagree about important legal issues.”
Warning about Plain Speaking - Gonzales says Obama’s attorney general nominee, Eric Holder, should refrain from making such statements as Holder made last week when he testified that waterboarding is torture. “One needs to be careful in making a blanket pronouncement like that,” Gonzales says, adding that such a statement might affect the “morale and dedication” of intelligence officials and lawyers who are attempting to make cases against terrorism suspects. (Halloran 1/26/2009)

John Yoo, the former Bush administration legal adviser who authored numerous opinions on the legality of torture, detentions without legal representation, and warrantless wiretapping (see November 6-10, 2001, December 28, 2001, January 9, 2002, August 1, 2002, and August 1, 2002, among others), writes an op-ed for the Wall Street Journal opposing the Obama administration’s intent to close the Guantanamo Bay detention facility (see January 20, 2009 and January 22, 2009)) and restrict the CIA’s ability to torture detainees (see January 22, 2009). Yoo, now a law professor and a member of the neoconservative American Enterprise Institute, writes that while President Obama’s decision “will please his base” and ease the objections to the Bush “imperial presidency,” it will “also seriously handicap our intelligence agencies from preventing future terrorist attacks.” Yoo writes that the Obama decisions mark a return “to the failed law enforcement approach to fighting terrorism that prevailed before Sept. 11, 2001.” Yoo recommends that Obama stay with what he calls “the Bush system” of handling terror suspects. Yoo fails to note that the US law enforcement system prevented, among others, the “millennium bombing” plot (see December 14, 1999), the plot to bomb New York City’s Lincoln and Holland Tunnels (see June 24, 1993), and Operation Bojinka (see January 6, 1995).
Obama Needs to be Able to Torture Prisoners Just as Bush Did, Yoo Declares - And by eschewing torture, Obama is giving up any chance on forcing information from “the most valuable sources of intelligence on al-Qaeda” currently in American custody. The Bush administration policies prevented subsequent terrorist attacks on the US, Yoo contends, and Obama will need the same widespread latitude to interrogate and torture prisoners that Bush employed: “What is needed are the tools to gain vital intelligence, which is why, under President George W. Bush, the CIA could hold and interrogate high-value al-Qaeda leaders. On the advice of his intelligence advisers, the president could have authorized coercive interrogation methods like those used by Israel and Great Britain in their antiterrorism campaigns. (He could even authorize waterboarding, which he did three times in the years after 9/11.)” It is noteworthy that Yoo refused to confirm that Bush ordered waterboarding of suspects during his previous Congressional hearings (see June 26, 2008).
Interrogations Must be 'Polite' - According to Yoo, in forcing the CIA and other US interrogators to follow the procedures outlined in the Army Field Manual, they can no longer use “coercive techniques, threats and promises, and the good-cop bad-cop routines used in police stations throughout America.… His new order amounts to requiring—on penalty of prosecution—that CIA interrogators be polite. Coercive measures are unwisely banned with no exceptions, regardless of the danger confronting the country.” (Yoo 1/29/2009) Yoo is incorrect in this assertion. The Army Field Manual explicitly countenances many of the “coercive techniques, threats and promises, and the good-cop bad-cop routines” Yoo says it bans. Further, the Field Manual says nothing about requiring interrogators to be “polite.” (Army 9/2006) And actual field interrogators such as the Army’s Matthew Alexander have repeatedly said that torturing prisoners is ineffective and counterproductive, while building relationships and treating prisoners with dignity during interrogations produces usable, reliable intelligence (see November 30, 2008).
Shutting Down Military Commissions - Obama’s order to stay all military commission trials and to review the case of “enemy combatant” Ali Saleh al-Marri (see June 23, 2003) is also mistaken, Yoo writes. Yoo fears that Obama will shut down the military commissions in their entirety and instead transfer detainees charged with terrorist acts into the US civilian court system. He also objects to Obama’s apparent intent to declare terrorists to be prisoners of war under the Geneva Conventions, instead of following the Bush precedent of classifying terrorists “like pirates, illegal combatants who do not fight on behalf of a nation and refuse to obey the laws of war.” To allow terror suspects to have rights under Geneva and the US legal system, Yoo asserts, will stop any possibility of obtaining information from those suspects. Instead, those suspects will begin using the legal system to their own advantage—refusing to talk, insisting on legal representation and speedy trials instead of cooperating with their interrogators. “Our soldiers and agents in the field will have to run more risks as they must secure physical evidence at the point of capture and maintain a chain of custody that will stand up to the standards of a civilian court,” Yoo writes. (Yoo 1/29/2009) In reality, the Supreme Court’s ruling in Hamdan v. Rumsfeld (see June 30, 2006), as well as the Detainee Treatment Act (see December 15, 2005) and the Military Commissions Act (see October 17, 2006), all mandate that detainees must be handled according to the Geneva Conventions.
Risk to Americans - Another effect of transferring detainees into the civilian justice system, Yoo claims, is to allow “our enemies to obtain intelligence on us.” Defense lawyers will insist on revealing US intelligence—information and methods—in open court, and will no doubt force prosecutors to accept plea bargains “rather than risk disclosure of intelligence secrets.”
Obama 'Open[ed] the Door to Further Terrorist Acts on US Soil' - Obama said in his inaugural speech that the US must “reject as false the choice between our safety and our ideals.” Yoo calls that statement “naive,” and writes, “That high-flying rhetoric means that we must give al-Qaeda—a hardened enemy committed to our destruction—the same rights as garden-variety criminals at the cost of losing critical intelligence about real, future threats.” By making his choices, Yoo writes, “Mr. Obama may have opened the door to further terrorist acts on US soil by shattering some of the nation’s most critical defenses.” (Yoo 1/29/2009)

Reflecting on the Bush administration’s prewar insistence that Iraq had a nuclear weapons program (see September 4, 2002, September 8, 2002, and September 8, 2002, among others), Sir Jeremy Greenstock, Britain’s former ambassador to the UN and its former special representative in Iraq, says: “When I arrived in New York, in July 1998, it was quite clear to me that all the members of the Security Council, including the United States, knew well that there was no current work being done on any kind of nuclear weapons capability in Iraq. It was, therefore, extraordinary to me that later on in this saga there should have been any kind of hint that Iraq had a current capability. Of course, there were worries that Iraq might try, if the opportunity presented itself, to reconstitute that capability. And therefore we kept a very close eye, as governments do in their various ways, on Iraq trying to get hold of nuclear base materials, such as uranium or uranium yellowcake, or trying to get the machinery that was necessary to develop nuclear-weapons-grade material. We were watching this the whole time. There was never any proof, never any hard intelligence, that they had succeeded in doing that. And the American system was entirely aware of this.” (Murphy and Purdum 2/2009)

George W. Bush’s former political guru Karl Rove echoes incorrect statements made by former Bush lawyer John Yoo. In an op-ed, Yoo claimed that President Obama’s prohibition against torture, and the mandate for US interrogators to use the Army Field Manual as their guide, prevents interrogators from using long-established, non-invasive techniques to question prisoners (see January 29, 2009). In an address at Loyola Marymount University, Rove tells his listeners: “The Army Field Manual prohibits ‘good cop, bad cop.’ All that stuff you see on CSI—the Army Field Manual prohibits it.… If you stop collecting that information, you begin to make America more at risk.” (Maddaus 2/3/2009) Both Rove and Yoo are wrong. The Army Field Manual explicitly permits many of the “coercive techniques, threats and promises, and the good-cop bad-cop routines” Yoo and Rove claim it bans. (Army 9/2006)

MSNBC host Keith Olbermann slams former Vice President Dick Cheney for Cheney’s recent warnings concerning the policies of President Obama (see February 4, 2009). Olbermann calls Cheney’s remarks a “destructive and uninformed diatribe… that can only serve to undermine the nation’s new president, undermine the nation’s effort to thwart terrorism, and undermine the nation itself.” Cheney said that the Obama administration seems “more concerned about reading the rights to an al-Qaeda terrorist than they are with protecting the United States against people who are absolutely committed to do anything they can to kill Americans.” Olbermann responds by asking: “What delusion of grandeur makes you think you have the right to say anything like that? Because a president, or an ordinary American, demands that we act as Americans and not as bullies; demands that we play by our rules; that we preserve, protect, and defend the Constitution of the United States; you believe we have chosen the one and not the other? We can be Americans, or we can be what you call ‘safe’—but not both?” Olbermann says that the Bush-Cheney policies—the so-called “Bush System,” as recently dubbed by former Bush administration lawyer John Yoo (see January 29, 2009)—“[s]tart[ed] the wrong war, detain[ed] the wrong people, employ[ed] the wrong methods, pursue[d] the wrong leads, utilize[d] the wrong emotions.” He continues: “We, sir, will most completely assure our security not by maintaining the endless, demoralizing, draining, life-denying blind fear and blind hatred which you so thoroughly embody. We will most easily purchase our safety by repudiating the ‘Bush System.’ We will reserve the violence for which you are so eager, sir, for any battlefield to which we truly must take, and not for unconscionable wars which people like you goad and scare and lie us into. You, Mr. Cheney, you terrified more Americans than did any terrorist in the last seven years, and now it is time for you to desist, or to be made to desist. With damnable words like these, sir, you help no American, you protect no American, you serve no American—you only aid and abet those who would destroy this nation from within or without.” (Olbermann 2/5/2009)

Secretary of State Hillary Clinton says she is not sure whether North Korea actually has a secret program to enrich uranium, as the Bush administration had long claimed. She adds that she intends to persuade Pyongyang to give up the weapons-grade plutonium it does possess. “There is a debate within the intelligence community as to exactly the extent of the highly-enriched-uranium program,” she says. “My goal is the denuclearization of North Korea,” she continues. “That means a verifiably complete accounting of whatever programs they have and the removal of the reprocessed plutonium that they were able to achieve because they were given the opportunity to do so.… When they move forward” on ending the program, “we have a great openness to working with them, [and] a willingness to help the people of North Korea.”
Broadening Focus Beyond Uranium Possession - The claim of the uranium program led to the Bush administration’s rejection of the 1994 agreement that kept the North Korean nuclear weapons program in check (see October 21, 1994), she says: “The Agreed Framework was torn up on the basis of the concerns about the highly-enriched-uranium program. There is no debate that, once the Agreed Framework was torn up, the North Koreans began to reprocess plutonium with a vengeance because all bets were off. The result is they now have nuclear weapons, which they did not have before.” When the Bush administration withdrew from the Agreed Framework (see October 20, 2002), Clinton says, North Korea restarted its plutonium-based reactor at Yongbyon and now has enough material for at least a half-dozen nuclear weapons. A 2006 nuclear test by the North Koreans prompted Bush officials to reopen negotiations and eventually craft a new agreement remarkably similar to the Agreed Framework (see February 8, 2007 and After). Most Asian nations are expected to welcome Clinton’s new position on the uranium issue, as they thought the Bush administration had put too much emphasis on North Korea’s uranium possession. (Kessler 2/15/2009) Clinton also warns North Korea not to test-fire a long-range ballistic missile (see February 15, 2009).
'Old Wine in a New Bottle' - The senior editorial writer for South Korea’s Hankyoreh newspaper, Jungsoo Jang, calls the Clinton proposal little more than “old wine in a new bottle,” writing: “Of course, the side by side denuclearization and normalization plan elucidated by Clinton clearly does represent a considerable change from the Bush administration, which focused on a schematic view of denuclearization first, normalization second. But Clinton’s solution does have limitations, in that normalization of North Korea-US relations cannot be pursued as long as prior issues such as total abolition of nuclear weapons and suspicions about enriched uranium are not neatly resolved.” Jang says that a conflict between a more conservative camp and a more progressive camp in the Obama State Department is currently being won by the conservatives, who favor an emphasis on US-Japanese relations and a more direct, confrontational approach to dealing with North Korea’s nuclear program. In a speech at the Nixon Center, neoconservative guru Richard Perle (see 1965 and Early 1970s) attempts to drastically rewrite the history of the Bush administration and his role in the invasion of Iraq. The Washington Post’s Dana Milbank writes that listening to Perle gave him “a sense of falling down the rabbit hole.” Milbank notes: “In real life, Perle was the ideological architect of the Iraq war and of the Bush doctrine of preemptive attack (see 1987-2004, Late December 2000 and Early January 2001, March, 2001, Shortly After September 11, 2001, September 15, 2001, September 19-20, 2001, November 14, 2001, November 14, 2001, November 18-19, 2001, May 2002, August 16, 2002, November 20, 2002, January 9, 2003, February 25, 2003, and March 27, 2003). But at yesterday’s forum of foreign policy intellectuals, he created a fantastic world in which:

bullet Neoconservatives do not exist.
bullet Even if neoconservatives did exist, they certainly couldn’t be blamed for the disasters of the past eight years.” (Milbank 2/20/2009)

'No Such Thing as a Neoconservative Foreign Policy' - Perle tells the gathering, hosted by National Interest: “There is no such thing as a neoconservative foreign policy. It is a left critique of what is believed by the commentator to be a right-wing policy.” Perle has shaped the nation’s foreign policy since 1974 (see August 15, 1974, Early 1976, 1976, and Early 1981). He was a key player in the Reagan administration’s early attempts to foment a nuclear standoff with the Soviet Union (see Early 1981 and After, 1981 and Beyond, September 1981 through November 1983, May 1982 and After, and October 11-12, 1986). Perle denies any real involvement with the 1996 “Clean Break” document, which Milbank notes “is widely seen as the cornerstone of neoconservative foreign policy” (see July 8, 1996 and March 2007). Perle explains: “My name was on it because I signed up for the study group. I didn’t approve it. I didn’t read it.” In reality, Perle wrote the bulk of the “Clean Break” report. Perle sidesteps questions about the letters he wrote (or helped write) to Presidents Clinton and Bush demanding the overthrow of Saddam Hussein (see January 26, 1998, February 19, 1998, and September 20, 2001), saying, “I don’t have the letters in front of me.” He denies having any influence on President Bush’s National Security Strategy, which, as Milbank notes, “enshrin[ed] the neoconservative themes of preemptive war and using American power to spread freedom” (see May 1, 2001), saying: “I don’t know whether President Bush ever read any of those statements [he wrote]. My guess is he didn’t.” Instead, as Perle tells the audience: “I see a number of people here who believe and have expressed themselves abundantly that there is a neoconservative foreign policy and it was the policy that dominated the Bush administration, and they ascribe to it responsibility for the deplorable state of the world. None of that is true, of course.” Bush’s foreign policy had “no philosophical underpinnings and certainly nothing like the demonic influence of neoconservatives that is alleged.” And Perle claims that no neoconservative ever insisted that the US military should be used to spread democratic values (see 1965, Early 1970s, Summer 1972 and After, August 15, 1974, 1976, November 1976, Late November, 1976, 1977-1981, 1981 and Beyond, 1984, Late March 1989 and After, 1991-1997, March 8, 1992, July 1992, Autumn 1992, July 8, 1996, Late Summer 1996, Late Summer 1996, 1997, November 12, 1997, January 26, 1998, February 19, 1998, May 29, 1998, July 1998, February 1999, 2000, September 2000, November 1, 2000, January 2001, January 22, 2001 and After, March 12, 2001, Shortly After September 11, 2001, September 20, 2001, September 20, 2001, September 20, 2001, September 24, 2001, September 25-26, 2001, October 29, 2001, October 29, 2001, November 14, 2001, November 20, 2001, November 29-30, 2001, December 7, 2001, February 2002, April 2002, April 23, 2002, August 6, 2002, September 4, 2002, November 2002-December 2002, November 12, 2002, February 2003, February 13, 2003, March 19, 2003, December 19, 2003, March 2007, September 24, 2007, and October 28, 2007), saying, “I can’t find a single example of a neoconservative supposed to have influence over the Bush administration arguing that we should impose democracy by force.” His strident calls for forcible regime change in Iran were not what they seemed, he says: “I’ve never advocated attacking Iran. Regime change does not imply military force, at least not when I use the term” (see July 8-10, 1996, Late Summer 1996, November 14, 2001, and January 24, 2004).
Challenged by Skeptics - Former Reagan administration official Richard Burt (see Early 1981 and After and May 1982 and After), who challenged Perle during his time in Washington, takes issue with what he calls the “argument that neoconservatism maybe actually doesn’t exist.” He reminds Perle of the longtime rift between foreign policy realists and neoconservative interventionists, and argues, “You’ve got to kind of acknowledge there is a neoconservative school of thought.” Perle replies, “I don’t accept the approach, not at all.” National Interest’s Jacob Heilbrunn asks Perle to justify his current position with the title of his 2003 book An End to Evil. Perle claims: “We had a publisher who chose the title. There’s hardly an ideology in that book.” (Milbank provides an excerpt from the book that reads: “There is no middle way for Americans: It is victory or holocaust. This book is a manual for victory.”) Perle blames the news media for “propagat[ing] this myth of neoconservative influence,” and says the term “neoconservative” itself is sometimes little more than an anti-Semitic slur. After the session, the moderator asks Perle how successful he has been in making his points. “I don’t know that I persuaded anyone,” he concedes. (Milbank 2/20/2009)
'Richard Perle Is a Liar' - Harvard professor Stephen Walt, a regular columnist for Foreign Policy magazine, writes flatly, “Richard Perle is a liar.” He continues: “[K]ey neoconservatives like Douglas Feith, I. Lewis ‘Scooter’ Libby, Paul Wolfowitz, and others [were] openly calling for regime change in Iraq since the late 1990s and… used their positions in the Bush administration to make the case for war after 9/11, aided by a chorus of sympathetic pundits at places like the American Enterprise Institute, and the Weekly Standard. The neocons were hardly some secret cabal or conspiracy, as they were making their case loudly and in public, and no serious scholar claims that they ‘bamboozled’ Bush and Cheney into a war. Rather, numerous accounts have documented that they had been openly pushing for war since 1998 and they continued to do so after 9/11.… The bottom line is simple: Richard Perle is lying. What is disturbing about this case is is not that a former official is trying to falsify the record in such a brazen fashion; Perle is hardly the first policymaker to kick up dust about his record and he certainly won’t be the last. The real cause for concern is that there are hardly any consequences for the critical role that Perle and the neoconservatives played for their pivotal role in causing one of the great foreign policy disasters in American history. If somebody can help engineer a foolish war and remain a respected Washington insider—as is the case with Perle—what harm is likely to befall them if they lie about it later?” (Walt 2/23/2009)

[Source: Reuters / Fadi Al-Assaad / MinnPost (.com)]In a wide-ranging seminar with former Democratic Vice President Walter Mondale and investigative journalist Seymour Hersh at the University of Minnesota, Hersh claims that he has evidence that the US operated what he calls an “executive assassination wing” during the Bush administration, perhaps controlled by the office of then Vice President Dick Cheney. (Black 3/11/2009) (Hersh will later say he used the word “wing,” but it was widely misreported as “ring” in the media.) (Blitzer 3/30/2009) Hersh says he will explain his charges more fully in an upcoming book. When asked about recent instances of a president exceeding his constitutional authority, Hersh gives a response that moves from CIA activities, through the Joint Special Operations Command, to the alleged “assassination wing”: “After 9/11, I haven’t written about this yet, but the Central Intelligence Agency was very deeply involved in domestic activities against people they thought to be enemies of the state. Without any legal authority for it. They haven’t been called on it yet. Right now, today, there was a story in the New York Times that if you read it carefully mentioned something known as the Joint Special Operations Command—JSOC it’s called. It is a special wing of our special operations community that is set up independently. They do not report to anybody, except in the Bush-Cheney days, they reported directly to the Cheney office. They did not report to the chairman of the Joint Chiefs of Staff or to Mr. [Robert] Gates, the secretary of defense. They reported directly to him.… Congress has no oversight of it. It’s an executive assassination wing essentially, and it’s been going on and on and on. Just today in the Times there was a story that its leaders, a three star admiral named [William H.] McRaven, ordered a stop to it because there were so many collateral deaths. Under President Bush’s authority, they’ve been going into countries, not talking to the ambassador or the CIA station chief, and finding people on a list and executing them and leaving. That’s been going on, in the name of all of us. It’s complicated because the guys doing it are not murderers, and yet they are committing what we would normally call murder. It’s a very complicated issue. Because they are young men that went into the Special Forces. The Delta Forces you’ve heard about. Navy Seal teams. Highly specialized. In many cases, they were the best and the brightest. Really, no exaggerations. Really fine guys that went in to do the kind of necessary jobs that they think you need to do to protect America. And then they find themselves torturing people. I’ve had people say to me—five years ago, I had one say: ‘What do you call it when you interrogate somebody and you leave them bleeding and they don’t get any medical committee and two days later he dies. Is that murder? What happens if I get before a committee?’ But they’re not gonna get before a committee.” Mondale says of Cheney and his office that “they ran a government within a government.” Hersh adds, “Eight or nine neoconservatives took over our country.” Mondale notes that the precedents of abuse of vice presidential power by Cheney would remain “like a loaded pistol that you leave on the dining room table.” (Black 3/11/2009) CIA spokesman George Little responds to Hersh’s allegation by writing: “I saw your story on Seymour Hersh’s recent allegations regarding CIA activities since 9/11. If you wish, you can attribute the quoted portion that follows to me, in name, as a CIA spokesman: ‘This is utter nonsense.’” (Black 3/12/2009)

Former Nixon White House counsel John Dean says that the allegation of an “executive assassination wing,” as recently made by investigative reporter Seymour Hersh (see March 10, 2009), could well be a war crime if it is true. Both Dean and MSNBC host Keith Olbermann note that if true, Cheney’s actions could well violate a 1976 executive order that states in part, “No employee of the United States government shall engage in or conspire to engage in political assassination.” Dean says: “[F]ighting terrorism is not dealing with tiddlywinks. We want our government to deal with the most effective tools they have. But they also have to be legal. The executive order, really, is nothing more than direction to the executive branch and the presidency is the only one who you can even argue might have the authority to engage in assassinations. It’s an unresolved question. So, it’s potentially a war crime, it’s potentially just outright murder, and it could clearly be in violation of the Ford executive order.” In the same broadcast, author and political analyst Howard Fineman says of Hersh’s report: “In checking around in the intelligence community today, I can say this, you know, Seymour Hersh is somebody they respect. They don’t always trust. But they put it this way, as one of them said to me, ‘Look, I don’t know anything about this specifically at all, but I wouldn’t dismiss what Sy Hersh is saying without checking carefully.’ That’s their backhanded way of saying it’s worth looking into, for sure.” (MSNBC 3/12/2009)

[Source: AeroSpaceWeb (.org)]According to the Boston Globe, Defense Secretary Robert Gates is preparing to announce sweeping cuts in weapons programs over the following months. Gates, the only holdover in the Obama administration from the Bush cabinet, said before President Bush left office that the US “cannot expect to eliminate national security risks through higher defense budgets, to do everything and buy everything.” Whoever President Obama’s new defense secretary might be, he then said, would have to eliminate some costly hardware and invest in new tools for fighting insurgents. At that point, Gates did not know that he would be asked to stay on as defense secretary.
Scope of Cuts - Senior defense officials say that the impending program cuts will be the largest since the end of the Cold War, during the administrations of Ronald Reagan and George H. W. Bush. About a half-dozen programs will be canceled, including the Air Force’s F-22 fighter jet, a new Navy destroyer, Army ground combat vehicles, and other programs such as aircraft carriers and new nuclear weapons.
Gates' Role - The Globe reports: “As a former CIA director with strong Republican credentials, Gates is prepared to use his credibility to help Obama overcome the expected outcry from conservatives. And after a lifetime in the national security arena, working in eight administrations, the 65-year-old Gates is also ready to counter the defense companies and throngs of retired generals and other lobbyists who are gearing up to protect their pet projects.” Pentagon spokesman Geoff Morrell says, “He has earned a great deal of credibility over the past two years, both inside and outside the Pentagon, and now he is prepared to use it to lead the department in a new direction and bring about the changes he believes are necessary to protect the nation’s security.”
Support - James Shinn, who served under Gates as an assistant defense secretary in the Bush administration, says Gates is perhaps the only person in Washington who can make such drastic cuts happen: “He obviously has huge credibility as something of a hawk. No one can even remotely challenge Gates in terms of his well-informed and conservative approach toward threats and the weapon systems associated with threats.” Longtime Washington official Brent Scowcroft, one of Gates’ closest friends and mentors, says: “He is going to have a hard time. The resistance in the system is heavy. But that what Bob is trying to take on.”
Potential Opposition - However, any cuts will face strong opposition from defense contractors and members of Congress whose districts rely on defense monies. “There are so many people employed in the industry and they are spread across the country,” says William Cohen, a Republican who served as defense secretary in the Clinton administration. “Even though members of Congress may say, ‘It’s great that you are recommending the termination of X, Y, and Z,’ they will also say ‘that means 4,000 jobs in my state. Frankly, I can’t go along with that.’” The declining economy makes such arguments even more compelling, Cohen adds. (Bender 3/17/2009)

[Source: PBS]Former Secretary of State Condoleezza Rice tells PBS’s Charlie Rose that “no one” in the White House ever asserted that Saddam Hussein had any connections to 9/11. Rose says, “But you didn’t believe [the Hussein regime] had anything to do with 9/11.” Rice replies: “No. No one was arguing that Saddam Hussein somehow had something to do with 9/11.… I was certainly not. The president was certainly not.… That’s right. We were not arguing that.” Rice refuses to answer Rose’s question asking if former Vice President Dick Cheney ever tried to make the connection. Conservative commentator Bill O’Reilly writes an op-ed that claims, apparently sarcastically, that former Vice President Cheney would have had reporters assassinated if he really controlled a military assassination squad. Responding to the allegations by investigative journalist Seymour Hersh that Cheney controlled an “executive assassination wing” (see March 10, 2009), O’Reilly writes: “The other day, left-wing muckraker Seymour Hersh went on MSNBC and said he had information, provided by the usual anonymous sources, that Dick Cheney was running an assassination squad out of the White House. I have but one simple observation: If Cheney really had such a crew, Hersh would have been dead a long time ago, and so would most everybody at MSNBC.” (O'Reilly 3/22/2009; Corley 3/22/2009)

[Source: Foreign Policy Initiative]Neoconservatives form a new think tank to rehabilitate their image and regain some of the influence they had under the Bush administration, according to news reports. The Foreign Policy Initiative (FPI) is headed by Weekly Standard publisher William Kristol, foreign policy consultant Robert Kagan, and former Bush administration official Dan Senor. Its first activity will be to sponsor a March 31 conference (see March 31, 2009) pushing for a US “surge” in Afghanistan similar to the one Kagan helped plan for Iraq (see January 2007).
Successor to PNAC - Many see the FPI as the logical successor to Kristol and Kagan’s previous neoconservative organization, the now-defunct Project for the New American Century (PNAC—see January 26, 1998). PNAC’s membership roll included many prominent Bush administration officials, including then-Vice President Dick Cheney and the Defense Department’s top two officials, Donald Rumsfeld and Paul Wolfowitz.
Employees - Information about FPI’s creation is initially sketchy, with the organization deliberately avoiding media attention. Two of its three listed staff members, Jamie Fly and Christian Whiton, are former Bush administration officials, while the third, Rachel Hoff, last worked for the National Republican Congressional Committee.
Mission Statement; Conflict with China, Russia - FPI’s mission statement says that the “United States remains the world’s indispensable nation,” and warns that “strategic overreach is not the problem and retrenchment is not the solution” to Washington’s current financial and strategic woes. It calls for “continued engagement—diplomatic, economic, and military—in the world and rejection of policies that would lead us down the path to isolationism.” The statement lists a number of threats to US security, including “rogue states,” “failed states,” “autocracies,” and “terrorism,” but focuses primarily on the “challenges” posed by “rising and resurgent powers,” of which only China and Russia are named. Kagan has argued that the 21st century will be dominated by an apocalyptic struggle between the forces of democracy, led by the US, and the forces of autocracy, led by China and Russia. He has called for the establishment of a League of Democracies to oppose China and Russia; the FPI statement stresses the need for “robust support for America’s democratic allies.” Apparently, confrontation with China and Russia will be the centerpiece of FPI’s foreign policy stance, a similar position to that taken by the Bush administration before the 9/11 attacks.
Reactions to New Think Tank - Steven Clemons of the New America Foundation says: “This reminds me of the Project for the New American Century. Like PNAC, it will become a watering hole for those who want to see an ever-larger US military machine and who divide the world between those who side with right and might and those who are evil or who would appease evil.” Reporters Daniel Luban and Jim Lobe write, “[T]he formation of FPI may be a sign that its founders hope once again to incubate a more aggressive foreign policy during their exile from the White House, in preparation for the next time they return to political power.” (Luban and Lobe 3/25/2009)

CNN anchor Wolf Blitzer interviews investigative journalist Seymour Hersh, who recently alleged that an “executive assassination wing” operated out of the White House (see March 10, 2009). Blitzer notes that the entity Hersh cited, the Joint Special Operations Command (JSOC), denies Hersh’s claim, and says, in Blitzer’s words, “their forces operate under established rules of engagement and the law of armed conflict.” The JSOC “has no command and control authorities over the US military,” the JSOC has told Blitzer. Additionally, former Bush national security expert Frances Townsend has denied Hersh’s claim.
Not New Reporting - Hersh tells Blitzer that though he has not written specifically about the “assassination wing,” he and others have written about the actions of the JSOC well before now. “[I]t’s a separately independent unit that does not report to Congress, at least in the years I know about.… It has been given executive authority by the president in as many as 12 countries to go in and kill we’re talking about high value targets. That’s absolutely correct.” He says that such actions are not only illegal, but have no basis in intelligence. “The idea that you’re telling a group of American combat soldiers,” he says, “[t]he idea that we have a unit set up who goes after high-value targets who up to a certain point I know for sure until very recently were clearing lists. That doesn’t mean Cheney has an assassination unit that he says I want to go get somebody. That’s how it sort of played out in the press. The idea that we have a unit that goes around and without reporting to Congress, Congress knows very little about this group, can’t get clearings, can’t get hearings, can’t get even a classified hearings on it. Congresspeople have told me this. Those are out and has authority for the president to go into a country without telling the CIA station chief or the ambassador and whack somebody and I’m sorry, Wolf, I have a lot of problems with that.”
Poor Choice of Phrase - Hersh says he regrets using the phrase “executive assassination wing,” because it is a “loaded phrase.” Word choice aside, Hersh says: “It comes down to the same thing, that you can—you’ve delegated authority to troops in the field to hit people on the basis of whatever intelligence they think is good and I can tell you it’s always not good and sometimes things get very bloody.… The bottom line is, it’s—if it were the way your little presentation set up, that everything was checked and cleared, in fact, it was an awful lot of delegation to this group, which does not brief the Congress. And this does raise profound questions of constitutional authority. It’s the same questions that have come up repeatedly in the Bush administration. That is a unitarian president, the notion that a president can do things without telling Congress and unilaterally. This is an extension of that issue.”
Implied Confirmation from Former Cheney Adviser - John Hannah, the former national security adviser to Vice President Cheney, says Hersh’s allegations are “not true,” but in his next statement, he seems to confirm Hersh’s allegations to an extent. Blitzer says: “Explain exactly what’s going on in terms of a list. Is there a list of terrorists, suspected terrorists, out there who can be assassinated?” Hannah replies: “There is—there’s clearly a group of people that go through a very extremely well-vetted process—interagency process, as I think was explained in your piece, that have committed acts of war against the United States, who are at war with the United States, or is suspected of planning operations of war against the United States, who authority is given, to our troops in the field in certain war theaters to capture or kill those individuals. That is certainly true.… Osama bin Laden and his number two are right at the top of the list. [The number of individuals to be assassinated] is a small group and the point is that it is very, very heavily vetted throughout the interagency process.” Hannah says that he has trouble believing that Congress was not aware of actions, presumably including possible assassinations, carried out by the JSOC: “I don’t know exactly what the consultations are with the Congress, but it’s hard for me to believe that those committee chairman and the leadership on the Hill involved in intelligence and armed services, if they want to know about these operations, cannot get that information through the Defense Department.” Asked if such assassinations are legal and Constitutional, Hannah says: “There is no question. And in a theater of war, when we are at war, and there’s no doubt, we are still at war against al-Qaeda in Iraq, al-Qaeda in Afghanistan, and on that Pakistani border, that our troops have the authority to go out after and capture and kill the enemy, including the leadership of the enemy.” (Blitzer 3/30/2009; Black 3/31/2009)

Investigative reporter Seymour Hersh discusses his recent allegation that what he calls an “executive assassination wing” was run from the office of former Vice President Dick Cheney (see March 10, 2009). Interviewer Amy Goodman opens her segment with Hersh by playing what was apparently an implicit confirmation, to an extent, of Hersh’s claims from a former Cheney aide (see March 30, 2009). Hersh notes that the comments from the former aide, John Hannah, verify that “yes, we go after people suspected—that was the word he used—of crimes against America. And I have to tell you that there’s an executive order, signed by Jerry Ford, President Ford, in the ‘70s, forbidding such action. It’s not only contrary—it’s illegal, it’s immoral, it’s counterproductive.” Of the allegations that the “assassination wing” is operated through the military’s Joint Special Operations Command (JSOC), Hersh says: “[T]he problem with having military go kill people when they’re not directly in combat, these are asking American troops to go out and find people and… they go into countries without telling any of the authorities, the American ambassador, the CIA chief, certainly nobody in the government that we’re going into, and it’s far more than just in combat areas. There’s more—at least a dozen countries and perhaps more. [President Bush] has authorized these kinds of actions in the Middle East and also in Latin America, I will tell you, Central America, some countries. They’ve been—our boys have been told they can go and take the kind of executive action they need, and that’s simply—there’s no legal basis for it.… [T]he idea that the American president would think he has the constitutional power or the legal right to tell soldiers not engaged in immediate combat to go out and find people based on lists and execute them is just amazing to me.… And not only that, Amy, the thing about George Bush is, everything’s sort of done in plain sight. In his State of the Union address (see 9:01 pm January 28, 2003)… about a month and a half before we went into Iraq, Bush was describing the progress in the war, and he said—I’m paraphrasing, but this is pretty close—he said that we’ve captured more than 3,000 members of al-Qaeda and suspected members, people suspected of operations against us. And then he added with that little smile he has, ‘And let me tell you, some of those people will not be able to ever operate again. I can assure you that. They will not be in a position.’ He’s clearly talking about killing people, and to applause. So, there we are. I don’t back off what I said. I wish I hadn’t said it ad hoc… sometimes when you speak off the top, you’re not as precise.” JSOC, Hersh explains, is a group of Navy Seals, Delta Force soldiers, and other “commandos” (a word the soldiers don’t prefer, but, Hersh says, most journalists use), which has been “transmogrified, if you will, into this unit that goes after high-value targets.” Hersh explains the involvement of Cheney’s office: “And where Cheney comes in and the idea of an assassination ring—I actually said ‘wing,’ but of an assassination wing—that reports to Cheney was simply that they clear lists through the vice president’s office. He’s not sitting around picking targets. They clear the lists. And he’s certainly deeply involved, less and less as time went on, of course, but in the beginning very closely involved.” Goodman concludes by asking, “One question: Is the assassination wing continuing under President Obama?” Hersh replies: “How do I know? I hope not.” (Democracy Now! 3/31/2009)

Retired Lieutenant General Thomas McInerney appears on Fox News to discuss piracy off the coast of Somalia. During the discussion, McInerney offers a plug for the F-22 Raptor fighter plane currently facing defunding (see March 17, 2009). McInerney says: “I’d put F-22s and combat air patrol out there, two of them, with tankers.… The reason I’d put the F-22s is because they can go 1.6 to Mach 2, and they have a very quick reaction time and a 20 millimeter cannon.” Neither McInerney nor Fox News informs their viewers that McInerney is a former consultant to Northrop Grumman, the defense contractor who builds the F-22. (Frick 4/9/2009) The day after McInerney’s appearance, reporter Ryan Tate observes that McInerney has been involved in previous instances of promoting defense contractors’ interests on television news shows (see Early 2002 and Beyond, April 19, 2003, April 14-16, 2006, Late 2006, and Late April, 2008). Of the F-22, Tate writes: “He neglected to mention virtually every US fighter made in the last 30 years carries such a cannon (usually the six-barrel M-61 Vulcan), including the F/A-18 Hornet already in use by the US Navy.… He also fails to mention that, no matter how fast the F-22 might be, it can’t be based off an aircraft carrier. So its reaction time could never be as good (from a land base on, say, the Arabian Peninsula) as a Hornet or other existing Navy jet floating in the waters nearest the pirates. Finally, McInerney fails to mention that, though capable of ground attack, the F-22 is optimized for air-to-air operations, i.e., shooting down other fighters.” (Tate 4/9/2009)

The Center for American Progress (CAP), a progressive think tank and lobbying organization, releases a report that says the “tea party” movement protesting the various policies of the Obama administration (see April 8, 2009) is not, as purported, entirely a grassroots movement of ordinary citizens, but an “astroturf” movement created, organized, and funded by powerful conservative and industry firms and organizations. (CAP notes that the anti-tax “tea parties,” with “tea” standing for “Taxed Enough Already,” fail to note that President Obama’s recent legislation actually has cut taxes for 95 percent of Americans.) Two of the most prominent organizations behind the “tea parties” are FreedomWorks and Americans for Progress (AFP). FreedomWorks (see April 14, 2009) is a corporate lobbying firm run by former House Majority Leader Dick Armey (R-TX), and organized the first “tea party,” held in Tampa, Florida, on February 27. It then began planning and organizing “tea parties” on a national scale; officials coordinated logistics, called conservative activists, and provided activists with sign ideas and slogans and talking points to use during protests. AFP has coordinated with FreedomWorks. AFP is a corporate lobbying firm run by Tim Phillips, a former lobbying partner of conservative activist Ralph Reed, and funded in part by Koch Industries, the largest private oil corporation in America (see May 29, 2009). Former House Speaker Newt Gingrich (R-GA) is also involved, through his lobbying form American Solutions for Winning the Future, which is supported by oil companies.
Support, Promotion from Fox News - On cable news channels, Fox News and Fox Business have run promotions for the “tea parties” in conjunction with enthusiastic reports promoting the affairs (see April 13-15, 2009, April 15, 2009, April 15, 2009, and April 6-13, 2009); in return, the organizers use the Fox broadcasts to promote the events. Fox hosts Glenn Beck, Neil Cavuto, and Sean Hannity all plan to broadcast live reports from the events. Fox also warns its viewers that the Obama administration may send “spies” to the events. (Fox justifies its depth of coverage by saying that it provided similar coverage for the 1995 Million Man March. However, Fox did not begin broadcasting until 1996—see October 7, 1996.)
Republican Support - Congressional Republicans have embraced the “tea parties” as ways to oppose the Obama administration. Many leading Republicans, such as Minority Leader John Boehner (R-OH), Paul Ryan (R-WI), and some 35 others, will speak at AFP-funded “tea parties.” Republican National Committee Chairman Michael Steele has moved the RNC to officially support the protests. And Senator David Vitter (R-LA) has introduced legislation formally honoring April 15 as “National Tea Party Day.” “It’s going to be more directed at Obama,” says reporter and commentator Ana Marie Cox. “This is very much, I think, part of the midterm strategy” to win elections in 2010.
Fringe Elements - According to CAP, many “fringe” elements of the conservative movement—including “gun rights militias, secessionists, radical anti-immigrant organizations, and neo-Nazi groups”—are involved in the “tea parties.” (Shakir et al. 4/15/2009; Fang 5/29/2009)

The White House releases four key Justice Department memos documenting the CIA’s use of harsh interrogation methods—torture—against suspected terrorists. The memos were released as a result of a Freedom of Information Act lawsuit filed by the American Civil Liberties Union (ACLU). The documents show that two high-level detainees were subjected to waterboarding at least 266 times between them. Al-Qaeda operative Abu Zubaida was waterboarded at least 83 times in August 2002, contradicting earlier CIA reports that he “broke” after a single waterboarding session (see December 10, 2007). Confessed 9/11 mastermind Khalid Shaikh Mohammed was waterboarded at least 183 times in March 2003. The so-called “insect” technique—exposure to insects within an enclosed box—was approved for use on Zubaida, but apparently never used. Numerous prisoners were subjected to “walling” and “sleep deprivation,” with at least one detainee subjected to the technique for 180 hours (over seven days). Three of the memos were written by then-Office of Legal Counsel (OLC) chief Steven Bradbury in May 2005 (see May 10, 2005, May 10, 2005, and May 30, 2005), and the fourth by Bradbury’s predecessor, Jay Bybee, in August 2002 (see August 1, 2002). (American Civil Liberties Union 4/16/2009; Shane 4/19/2009; BBC 4/23/2009) Senate Judiciary Committee chairman Patrick Leahy (D-VT) says: “These legal memoranda demonstrate in alarming detail exactly what the Bush administration authorized for ‘high value detainees’ in US custody. The techniques are chilling. This was not an ‘abstract legal theory,’ as some former Bush administration officials have characterized it. These were specific techniques authorized to be used on real people.” (CNN 4/17/2009) House Judiciary Committee chairman John Conyers (D-MI) agrees, saying: “This release, as well as the decision to ban the use of such techniques in the future, will strengthen both our national security and our commitment to the rule of law and help restore our country’s standing in the international community. The legal analysis and some of the techniques in these memos are truly shocking and mark a disturbing chapter in our nation’s history.” (Powers 4/16/2009) Senate Intelligence Committee chairwoman Dianne Feinstein (D-CA), whose committee is conducting an investigation of abusive interrogation methods used during the Bush administration, says Bush officials “inaccurately interpreted” the Geneva Conventions prohibiting torture. “I find it difficult to understand how the opinions found these interrogation techniques to be legal,” she says. “For example, waterboarding and slamming detainees head-first into walls, as described in the OLC opinions, clearly fall outside what is legally permissible.” (United Press International 4/16/2009)
White House Condemns Methods, Opposes Investigations - Attorney General Eric Holder says of the memos: “The president has halted the use of the interrogation techniques described in these opinions, and this administration has made clear from day one that it will not condone torture. We are disclosing these memos consistent with our commitment to the rule of law.” Holder adds that, according to a Justice Department statement, “intelligence community officials who acted reasonably and relied in good faith on authoritative legal advice from the Justice Department that their conduct was lawful, and conformed their conduct to that advice, would not face federal prosecutions for that conduct.” Holder states, “It would be unfair to prosecute dedicated men and women working to protect America for conduct that was sanctioned in advance by the Justice Department.” (US Department of Justice 4/16/2009) President Obama condemns what he calls a “dark and painful chapter in our history,” and promises that such torture techniques will never be used again. However, he restates his opposition to a lengthy investigation into the program, saying that “nothing will be gained by spending our time and energy laying blame for the past.” In contrast, Leahy says that the memos illustrate the need for an independent investigation. Dennis Blair, the director of national intelligence, points out that the memos were written at a time when the CIA was working to prevent a repeat of the 9/11 attacks. “Those methods, read on a bright, sunny, safe day in April 2009, appear graphic and disturbing,” he says. “But we will absolutely defend those who relied on these memos.” (Shane 4/19/2009) The ACLU demands criminal prosecution of Bush officials for their torture policies (see April 16, 2009). Techniques Include Waterboarding, Insect Exposure, 'Walling' - The memos show that several techniques were approved for use, including waterboarding, exposure to insects within a “confinement box,” being slammed into a wall, sleep deprivation, stress positions, forced nudity, and others. Waterboarded Well beyond Allowed Procedures - Because the information about the waterboarding of Zubaida and Mohammed comes from the classified and heavily redacted CIA’s inspector general report, which has not yet been released to the public, the information is at least in part based on the videotapes of Zubaida’s interrogation sessions that were later destroyed by CIA officials (see March 6, 2009). The CIA memo explained that detainees could be waterboarded between 12 and 18 times in a single day, but only on five days during a single month—which mathematically only adds up to 90 times in a month, and thus does not explain how Mohammed could have been waterboarded 183 times in a month if these procedures were being followed. The memos also reveal that in practice, the waterboarding went far beyond the methodologies authorized by the Justice Department and used in SERE training (see December 2001 and July 2002).
Information Unearthed by Blogger - Initial media reports fail to divulge the extraordinary number of times Zubaida and Mohammed were waterboarded. It falls to a blogger, Marcy Wheeler, to unearth the information from the CIA memo and reveal it to the public (see April 18, 2009). (Marcy Wheeler 4/18/2009)

[Source: Project Censored]Progressive blogger Marcy Wheeler, who posts under the moniker “emptywheel” at FireDogLake.com, finds that, upon careful perusal of the March 30, 2005 CIA torture memo just released by the Obama administration (see May 30, 2005 and April 16, 2009), two suspected terrorists, Abu Zubaida and Khalid Shaikh Mohammed, were waterboarded 266 times. Initial, more cursory news reports on the memo did not reveal this fact. The next day, the New York Times will cite Wheeler in its report on the discovery. (Marcy Wheeler 4/18/2009; Shane 4/19/2009) Wheeler writes: “The CIA wants you to believe waterboarding is effective. Yet somehow, it took them 183 applications of the waterboard in a one month period to get what they claimed was cooperation out of KSM. That doesn’t sound very effective to me.” (Marcy Wheeler 4/18/2009) Days later, an unidentified “US official with knowledge of the interrogation program” will tell a Fox News reporter that the claim of 183 waterboardings for Mohammed is inaccurate and misleading. Mohammed was only waterboarded five times, the official will claim. The figure of 183 is the number of “pours” Mohammed was subjected to. “The water was poured 183 times—there were 183 pours,” the official says, adding, “[E]ach pour was a matter of seconds.” The report of five waterboardings for Mohammed comes from a 2007 Red Cross report, the official will say. [Source: Chattahbox (.com)]Brian Kilmeade, a co-host of Fox News’s morning broadcast Fox and Friends, says he “feel[s] better” knowing that alleged 9/11 mastermind Khalid Shaikh Mohammed was waterboarded 183 times in a single month (see April 16, 2009 and April 18, 2009). “Guess what?” Kilmeade says. “Maybe if he were so scared of caterpillars [referring to militant training camp facilitator Abu Zubaida’s torture by insects—see August 1, 2002]… maybe he should have thought about that before he helped plot the taking down of 3,000-plus people on 9/11.” (Kilmeade is either unaware of, or ignoring, reports that show Zubaida may not have been a member of al-Qaeda and had no involvement in the 9/11 planning—see March 28, 2002, Shortly After March 28, 2002, and April 9, 2002 and After.) Kilmeade continues: “Khalid Shaikh Mohammed, I understand, was waterboarded 183 times. Did anyone care about that? Does anyone in America walk around going, ‘I’m really upset that the mastermind of 9/11 was waterboarded 183 times.’ That makes me feel better.… It’s unbelievable that people care more about Khalid Shaikh Mohammed, uh, his health, than they would about the future attacks that are being hatched.” (Media Matters 4/20/2009)

Following the release of a set of Bush administration memos about torture (see April 16, 2009) and the discovery that militant training camp facilitator Abu Zubaida was waterboarded 83 times in one month (see April 18, 2009), some commentators recall comments made by former CIA officer John Kiriakou.
Kiriakou's Media Blitz - In late 2007, shortly after the CIA admitted destroying videos of Zubaida (see November 2005 and December 6, 2007), Kiriakou toured media outlets, saying that Zubaida had only been waterboarded once (see December 10, 2007 and December 11, 2007). New York Times reporter Brian Stelter writes the most comprehensive treatment of Kiriakou’s “media blitz,” in an article entitled “How ‘07 ABC Interview Tilted a Torture Debate.” He points out that Kiriakou’s claim of only one waterboarding was “repeated by dozens of broadcasts, blogs, and newspapers” and “quickly ricocheted around the media.” This despite the fact that Kiriakou was not present at the black site where Zubaida was interrogated, and only learned of his treatment from reading accounts from the field. This injected the claim of one waterboarding into the public debate without the CIA having to make it itself. When asked about the false claim, CIA spokesman Paul Gimigliano replies: “This agency did not publicly disclose the frequency with which the waterboard was used, noting only that it was employed with three detainees. If reporters got that wrong, they weren’t misled from here.”
Waterboarding Was Necessary - In addition, Kiriakou said that at the time it did produce results and he had thought it was necessary then, statements that were repeated and amplified around the media. The net effect of his interjection in the debate was to make the torture seem much less harsh than it really was, diverting criticism away from the CIA. (Stelter 4/28/2009)
CIA Media Plant? - Numerous other commentators will make similar points. For example, in a piece entitled “John Kiriakou: CIA Media Plant?” Foreign Policy magazine commentator Annie Lowery says: “It all seems a bit strange to me, and leads to one obvious possibility: John Kiriakou—telegenic and well-spoken John Kiriakou, who never went to jail for blasting state secrets on television—was told the story to tell and released onto an unsuspecting public. It’s an impression the CIA will have difficulty dulling now.” (Lowery 4/28/2009)
Kiriakou Admits He Was Wrong - In 2010, Kiriakou will publish a book and in it he will mention in passing that his earlier claims were wrong. He did not take part in Zubaida’s interrogation and he was wrong about Zubaida being only waterboarded one time, and about him freely confessing afterwards. He will claim that he was a dupe used by the CIA to promote disinformation, writing, “In retrospect, it was a valuable lesson in how the CIA uses the fine arts of deception even among its own.” (Stein 1/26/2010)

Experts say that the so-called “ticking time bomb” scenario, which is often used to justify the use of torture, is fallacious. Many novels (see 1960), movies, and television shows, most recently Fox’s 24 (see Fall 2006), routinely portray a time-critical scene where the hero of the story must torture a prisoner to obtain information needed to avert an imminent attack, usually the “ticking time bomb” planted and ready to explode. Terrorism expert Bruce Hoffman says that such scenarios are dubious at best. “I’ve personally been told that they happen but I have to admit that in the years, in now the decade I have been told about it, I have become increasingly skeptical,” he says. “A ticking bomb becomes a default assumption which in turn becomes a legitimization or justification for torture. And in actual fact, even though people have told me about it, I have yet to see an actual documented case independently of what I was told.” Former CIA agent Michael Scheuer says that he knows of cases where torture elicited useful and critical information, but refuses to give specifics. CIA officials are unwilling or unable to provide details of the effectiveness of techniques such as waterboarding. Former military interrogator Matthew Alexander (see December 2-4, 2008) says of the CIA’s waterboarding of Khalid Shaikh Mohammed (see April 16, 2009 and April 18, 2009), “What I get most out of the waterboarding of Khalid Shaikh Mohammed is that any approach—I don’t care what it is—if you have to do it 183 times, it is not working,” he says. “When they did use the waterboard on Khalid Shaikh Mohammed, what they were getting each time was the absolute minimum he could get away with. And that’s what you get when you use torture—you get the absolute minimum amount of information.” (Temple-Raston 5/5/2009)

[Source: Public domain]Ibn al-Shaykh al-Libi, a former manager of a training camp for militants in Afghanistan, dies at Al Saleem jail in Libya. Al-Libi was captured and handed over to the US in 2001 (see December 19, 2001), and later provided information falsely linking Iraq and al-Qaeda while being tortured in Egyptian custody (see February 2002). The story of his death is broken by a Libyan newspaper named Oea, and picked up by media around the world. However, Newsweek will point out that Oea has “close ties to the [Libyan] government,” as it is owned by a son of Libyan dictator Colonel Mu’ammar al-Qadhafi. Workers with Human Rights Watch visited al-Libi at the prison on April 27, and spoke to him briefly, finding him reasonably well. Hafed al-Ghwell, a leading critic of the al-Qadhafi regime, will comment, “This idea of committing suicide in your prison cell is an old story in Libya.” Apparently, sometimes a prisoner is reported to have committed suicide, but when the family gets the body back, there is a bullet hole in its back or signs of torture. George Brent Mickum, a US lawyer representing al-Libi’s former partner in the training camp, US-held detainee Abu Zubaidah, says he had recently begun efforts through intermediaries to arrange to talk to al-Libi. “The timing of this is weird,” Mickum says. “My gut feeling is that something fishy happened here and somebody in Libya panicked,” adds al-Ghwell. (Isikoff and Hosenball 5/12/2009) Tom Malinowski of Human Rights Watch says: “I would speculate that he was missing because he was such an embarrassment to the Bush administration. He was Exhibit A in the narrative that tortured confessions contributed to the massive intelligence failure that preceded the Iraq war.” After the Bush administration used al-Libi’s claims of links between al-Qaeda and the Iraqi government to justify the US invasion of Iraq in 2003, al-Libi withdrew the claims. (Finn 5/12/2009) In October 2009, in a video posted on an Islamist website, al-Qaeda deputy leader Ayman al-Zawahiri will claim the US government “handed him over to the agents of al-Qadhafi to continue torturing him and kill him.” (Reuters 10/4/2009)

Stikkel/Released, via Reuters]Secretary of Defense Robert Gates and the chairman of the Joint Chiefs of Staff Admiral Michael Mullen announce the nomination of controversial former special/black operations commander Lieutenant General Stanley McChrystal to replace the top US commander in Afghanistan, General David McKiernan. At the Pentagon, Gates explains that “new leadership and fresh eyes” are needed to reverse the course of the seven-year-old war. “We have a new strategy, a new mission, and a new ambassador. I believe that new military leadership also is needed,” he says. The White House confirms that President Obama has signed off on the nomination. McChrystal is the former commander of the secretive Joint Special Operations Command (JSOC), which during his tenure was tied to prisoner abuse and covert assassinations in Iraq, as well as controversy in the military’s handling of the death of Pat Tillman in Afghanistan. McKiernan will remain in place until the Senate confirms the appointments of McChrystal and his designated deputy, Lieutenant General David Rodriguez, also a veteran of elite US forces. Both officers have experience in Afghanistan and have more familiarity with counterinsurgency operations than McKiernan. Gates says that McChrystal and Rodriguez will “bring a unique skill set in counterinsurgency to these issues, and I think that they will provide the kind of new leadership and fresh thinking that [Admiral Mike Mullen] and I have been talking about.” (CNN 5/11/2009; Tice 5/11/2009)
Prisoner Abuse, Geneva Convention Violations - Under McChrystal’s command, the Joint Special Operations Command supplied elite troops to a secret unit known variously as Task Force 626 and Task Force 121, based at Camp Nama (an acronym for “nasty ass military area”) near Baghdad. A Human Rights Watch report found evidence that the task force engaged in prisoner torture and abuse, and that the JSOC command likely violated the Geneva Conventions (see November 2004). According to the report, which was based on soldier testimony, inmates at the camp were subjected to beatings, exposure to extreme cold, threats of death, humiliation, and various forms of psychological abuse or torture. The report’s sources claimed that written authorizations were required for abusive techniques—indicating that the use of these tactics was approved up the chain of command—and that McChrystal denied the Red Cross and other investigators access to Camp Nama, a violation of the Geneva Conventions. (Schmitt and Marshall 3/19/2006; Sifton and Garlasco 7/22/2006; Doyle 5/17/2009)
Secret Assassinations - During McChrystal’s tenure as head of JSOC, he led campaigns to track down, capture, or kill enemies. To this end, McChrystal built a sophisticated network of soldiers and intelligence operatives to assassinate Sunni insurgent leaders and decapitate al-Qaeda in Iraq. He is also understood to have led the hunt for Osama bin Laden and other al-Qaeda leaders in Afghanistan and Pakistan. However, a Human Rights Watch report on the secret units under JSOC command states that although targets included Saddam Hussein and Abu Musab Al-Zarqawi, the operations also swept up “hundreds of anonymous, and often innocent, detainees.” One senior Pentagon officer, quoted by the Washington Post, warns, “People will ask, what message are we sending when our high-value-target hunter is sent to lead in Afghanistan?” (Sifton and Garlasco 7/22/2006; Tyson 5/13/2009) Newsweek has noted that JSOC is likely part of what then-Vice President Dick Cheney was referring to when he said America would have to “work the dark side” after 9/11 (see September 16, 2001). (Hirsh and Barry 6/26/2006) Furthermore, investigative reporter Seymour Hersh has reported that JSOC ran what he called an “executive assassination wing” that reported directly to Cheney’s office, which then cleared lists of people to be targeted for assassination by secret JSOC units (see March 10, 2009 and March 31, 2009).
Pat Tillman Silver Star Controversy - The Pentagon’s inspector general found McChrystal responsible for promulgating false and misleading information in the aftermath of the “friendly fire” death of Pat Tillman in 2004. In the controversy, McChrystal had approved paperwork recommending Tillman for a silver star, which stated that he died from “devastating enemy fire,” despite knowledge of internal investigations pointing to friendly fire as the cause of death (see April 29, 2004) and April 23-Late June, 2004). McChrystal then backtracked only when he learned that then-President Bush was about to quote from the misleading silver star citation in a speech. The US Army later overruled the Pentagon inspector general’s recommendation that McChrystal be held accountable for his actions. (Lindlaw and Mendoza 8/4/2007; Doyle 5/17/2009)

Stanley McChrystal arrives in Kabul with teams of counterinsurgency staff within days of his nomination to replace General David McKiernan (see May 11, 2009) as top commander in Afghanistan. Military and foreign policy analyst Mark Perry will later report that McChrystal “commandeers” McKiernan’s headquarters on arrival in Kabul. McChrystal’s teams then fan out all over the country to assess the need for a large increase in US troops to fight a strengthening insurgency. “They absolutely flooded the zone,” a US development officer will tell Perry. “There must have been hundreds of them. They were in every province, every village, talking to everyone. There were 10 of them for every one of us.” Perry will also cite a White House official who asserts that McChrystal and his team use the period before his official confirmation to the top post to begin building a case for more US troops. “From the minute that McChrystal showed up in Kabul, he drove the debate,” the White House official will say. “You’ll notice—from May on it was no longer a question of whether we should follow a military strategy or deploy additional troops. It was always, ‘should we do 20,000 or 30,000 or 40,000, or even 80,000’? We weren’t searching for the right strategy; we were searching for the right number.” (Perry 12/10/2009)

Conservative activist Curt Levey, the executive director of the Committee for Justice, attacks Supreme Court nominee Sonia Sotomayor (see May 26, 2009) as an “intellectual lightweight,” and compares her to the Bush administration’s failed nomination of White House lawyer Harriet Miers for the Court (see October 3-27, 2005). “I would point you to the Harriet Miers nomination under the second President Bush,” he tells radio listeners on WTOP. “She was also, many people felt, an intellectual lightweight, picked because she was a woman, people felt. And even though Republicans controlled the Senate, she ultimately had to withdraw. And that could happen here. This is someone who clearly was picked because she’s a woman and Hispanic, not because she was the best qualified. I could certainly see red and purple state Democrats gawking at it and she may very well have to withdraw her nomination.” (Terkel 5/26/2009) At the Washington Post and National Review, conservative columnist Ramesh Ponnaru attacks Sotomayor as “Obama’s Harriet Miers.” He continues to slam the nominee for asserting that judges sometimes make policy, claims—without naming names—that some Democrats believe she lacks “the intellect to be on the high court,” falsely claims that President Obama chose her because she passed “a pro-abortion litmus test,” criticizes her for having “empathy, at least for some groups” (a veiled reference to her Hispanic heritage and her gender), and claims that she has a “high reversal rate” before the Court. He calls her “the crassest of political picks.” (Ponnaru 5/26/2009; Ponnaru 5/26/2009)

The segment hinges on an upcoming trip by Obama to Europe and the Middle East. Scott asks if “the president’s upcoming trip [will] be what conservatives might call another apology tour”; in teasing Scott’s segment, Skinner raises the same point. Both Scott and Skinner then air cropped clips from Obama’s April 2009 visit to France. During his April speech, Obama both praised and criticized actions taken by the US, and criticized anti-American sentiment in Europe. However, Scott and Skinner air carefully selected portions of the speech to give impetus to their contention that Obama only criticized the US during his time in France. Fellow Fox News host Sean Hannity has suggested that Obama embarked on a “blame America first” visit and “apology tour.” On-air text and graphics illustrate the “apology tour” contention. Neither Scott nor Skinner inform their audience that in the same speech, Obama criticized Europe and praised the US. Guest Elliott Abrams, the convicted Iran-Contra conspirator (see October 7, 1991), advises Obama “to stop apologizing for our country,” and adds that Obama is making a mistake in spending time talking to Muslims during the trip. The Supreme Court refuses to hear an appeal concerning former CIA official Valerie Plame Wilson’s dismissed lawsuit against four Bush officials (see July 19, 2007). Plame Wilson had sued former Vice President Dick Cheney (see July 7-8, 2003), former White House political strategist Karl Rove (see July 8, 2003 and 11:00 a.m. July 11, 2003), convicted perjurer Lewis Libby (see March 6, 2007), and former Deputy Secretary of State Richard Armitage (see June 13, 2003), for deliberately disclosing her covert CIA status to reporters. Plame Wilson and her co-plaintiff, husband Joseph Wilson, have said their case is about “abuse of power at the highest level of American government.” The dismissal of their lawsuit was upheld by a federal appeals court in 2008. (Fox News 6/22/2009) In May, Solicitor General Elena Kagan urged the Court to deny the Wilsons’ appeal, saying that the lawsuit did not meet the criteria of the 1974 Privacy Act. The law, Kagan argued, barred federal employees from being sued; only their agencies could be sued. (Aquino 6/22/2009)

FBI whistleblower Sibel Edmonds testifies under oath in a deposition for the Schmidt v. Krikorian case. David Krikorian, a 2010 Democratic candidate for US Representative of Ohio, had been sued by Jean Schmidt (R-OH) in response to his claim that she had accepted “blood money” from the Turkish lobby in exchange for opposing an Armenian genocide resolution. As part of his defense against Schmidt’s charge that he had libeled her, Krikorian subpoenaed Edmonds’s testimony, as she had previously spoken and written about corruption of members of Congress by the Turkish Lobby. In two unrelated lawsuits prior to this one, Edmonds had been blocked from testifying by former Attorney General John Ashcroft, under the State Secrets Act. In Schmidt v. Krikorian, however, the Department of Justice under Attorney General Eric Holder does not reinvoke the claim of “state secrets” or otherwise move to block the testimony, and does not dispatch legal counsel to raise objections during the deposition. At the deposition, Krikorian is represented by Dan Marino of Mark Geragos’ law firm, Schmidt is represented by Bruce Fein, and Edmonds has retained Stephen M. Kohn of the National Whistleblower Center. Kohn says he has “asked [Sibel Edmonds] to limit her responses only to the information that she believes to be publicly available or she has learned from sources outside of her employment.” Marino begins his examination of Edmonds by asking basic questions about her background and work with the FBI, then works through a lengthy series of questions based on public statements Edmonds had made regarding events she witnessed. Much of this information has previously been reported, but for the first time, Edmonds is swearing to it under oath. Edmonds' Experience with Her FBI Co-worker Melek Can Dickerson and Her Husband, Major Douglas Dickerson - Edmonds and her husband Matthew Edmonds had previously said former FBI colleague Melek Can Dickerson and her husband, Major Douglas Dickerson, attempted to bribe her to pass on sensitive information (see December 2, 2001), and she confirms this. Edmonds had also previously reported to Congress and the Justice Department Inspector General that Melek Can Dickerson was spying for subjects of the FBI’s investigations (see (Late October 2001)), and she confirms this as well. (Edmonds 8/8/2009, pp. 22-34, 38)
Turkish Entities Targeted by FBI Investigations of Influence and Espionage - When asked if the American Turkish Council was a target of FBI investigations (see Late 1990s-Early 2001, Edmonds confirms it, but when asked to identify others, she declines to specifically name any. When asked about the “Turkish Lobby”, Edmonds says there is an overt and a covert lobby. The covert lobby involves “trying to obtain very sensitive, classified, highly classified US intelligence information, weapons technology information, classified congressional records, recruiting—recruiting key US individuals with access to highly sensitive information, blackmailing, bribery.” She testifies the Turkish government is indirectly involved, and that its concerns include access to US aid and weapons, as well as preventing Congress from passing a resolution acknowledging the Turkish genocide of the Armenians. Edmonds' 'State Secrets Privilege Gallery' - Marino asks the meaning of the ‘State Secrets Privilege Gallery’ at her website, justacitizen.com (see January 6, 2008). The gallery is a collection of photos without names; Edmonds explains it features the subjects of FBI investigations Edmonds was part of during her time as an FBI translator, whose names and criminal activities were being protected by claims of State Secrets and the gag orders she had been placed under. The twenty-one photos (including three place holders with question marks) feature current and former State and Defense Dept. officials; current and former members of Congress; and lobbyists and members of think tanks. Marino then names nine of the people listed in the gallery, and asks why they’re listed. As it had been reported by others that Marc Grossman was the person involved, Edmonds discusses, in some detail, her knowledge of his involvement with a criminal network stealing and selling US nuclear secrets (see January 6, 2008 and After), as well as his disclosure to a Turkish agent that Brewster Jennings was a CIA front company investigating nuclear trafficking (see Summer-Autumn 2001). Edmonds discusses the others in more general terms; Dennis Hastert (R-IL), Dan Burton (R-IN), Stephen Solarz (D-NY), Bob Livingston (R-LA) and Tom Lantos (D-CA) are all variously accused of accepting bribes in exchange for serving the interests of foreign governments, as well as involvement in blackmail and money laundering. Lantos is also accused of “disclosing highest level protected US intelligence and weapons technology information both to Israel and to Turkey.” Edmonds indicates the question mark in the Congressional group is a bisexual woman and a current member of Congress. Turkish agents wanted her to oppose an Armenian genocide resolution, and because her husband was an influential businessman. Edmonds did not include her photo in the gallery, and declines to name her in the deposition, as she is unaware if the congresswoman had actually been blackmailed, or done anything illegal. However, in an interview published in the November 2008 American Conservative, Edmonds names her as Jan Schakowsky (D-IL). (Edmonds 8/8/2009, pp. 42-84)
Indirect Knowledge of Illicit Israeli Influence on Congress - Asked if she is “aware of the Israeli government or Israeli organizations influencing members of Congress,” Edmonds responds, “Indirectly, based on how they work, some of the largest Israeli lobby groups with the entities such as ATC and also the Turkish diplomatic community and how they actually trained and make it possible for the Turkish lobby and these entities to do it. [T]hey had training period in ‘96 and ‘98 from individuals that were sent to them from both [AIPAC] and JINSA, both the lobbying, but also on… covering up the money track.” (Edmonds 8/8/2009, pp. 64)
Behrooz Sarshar's Testimony regarding FBI 9/11 Foreknowledge - Marino asks Edmonds about an entry on her Wikipedia page that said, “[Edmonds] claims that the FBI received information in April 2001 from a reliable Iranian intelligence asset that Osama bin Ladin was planning attacks on four to five cities with planes. Some of the people were already in the country, and the attacks would happen in a few months.” Edmonds clarifies that she knew of this incident from FBI translator Behrooz Sarshar (see April 2001), and her role was that she, “facilitated Mr. Sharshar’s meeting with 9/11Commission and also with the Glenn Fine, Department of Justice Inspector General’s Office, and… put him in touch with the members of media.” (Edmonds 8/8/2009, pp. 66-67)
How Blackmail Operations Are Conducted by Turkish Operatives - Sibel Edmonds explains how blackmail operations were conducted by Turkish agents. “[E]veryone was taught in [FBI] counterintelligence—that the target[,] US persons, whether they are in Congress or executive branch or whatever, first go by foreign entities to what they refer to as hooking period, and it was very common; it’s a very common way of trying to find vulnerability, and that is sexual, financial, any other kinds of greeds, and it was… being done a lot, and in some cases certain people from Pentagon would send a list of individuals with access to sensitive data, whether weapons technology or nuclear technology, and this information would include all their sexual preference, how much they owed on their homes, if they have gambling issues, and the State Department, high level State Department person would provide it to these foreign operatives, and those foreign operatives then would go and hook those Pentagon people, whether they were at RAND or some other Air Force base. And then the hooking period would take some times. Sometimes it takes months, sometimes one year. They would ask for small favor, but eventually after they reviewed the targets… then they would go blackmail and that person would give them everything, nuclear related information, weapons related information. It always worked for them. So it was not always money.” (Edmonds 8/8/2009, pp. 72-74)
The Historical Reality and Turkish Denial of the Armenian Genocide - Edmonds acknowledges the Ottoman genocide of Armenians as historical fact. She also notes that in Turkish society acknowledgment of the genocide is not permitted, and there are active efforts to suppress and dispute information and views related to it. (Edmonds 8/8/2009, pp. 78-81)
The Revolving Door between the US Government and the Turkish Lobby - Asked if she was aware that members of Congress have left office and become lobbyists for Turkey, Edmonds affirms her knowledge of Hastert, Solarz and Livingston having done so. She also adds, “But then there are people who work for these lobbying firms who are not the top, but they have received their share while they were working, whether they are in Pentagon. One person was Defense Intelligence Agency person, Dana Bauer, and now she works for Bob Livingston, but this individual, Ms. Bauer, did a lot of favors and illegal favors… for [the] government of Turkey and others, and then was hired by Livingston and put on a big salary to represent Turkish government. So it’s not only top tier of the lobbying firm, but then the people who work for them later and the various layers of those people.” (Edmonds 8/8/2009, pp. 83)
Quid Pro Quo: Congress and the Turkish Lobby - Attorney Marino solicits Edmonds understanding of Congress, lobbyists and ‘quid pro quo’, with a hypothetical example he deems “particularly relevant to our case”, saying: “You have a hypothetical Congresswoman from State X. Her district has no Turkish population to speak of or Armenian population to speak of. She’s the largest recipient of Turkish PAC money in the 2008 election cycle. All right? She meets with Livingston and Rogers or Livingston Group when they’re escorting members of the Turkish parliament to a reception. She receives fact sheets from the Livingston Group talking about Turkish relations; goes to luncheons in honor of the Turkish Foreign Minister, and she opposes Armenian genocide resolution and, in fact, refuses to even recognize the genocide as a historical fact.” Edmonds responds, “Based on several that I personally know about in terms of how they conduct and how they behave, those elected officials who are serving the foreign government’s interest, I would say that’s modus operandi that you describe. It’s a classic fit of how individuals who happen to owe their position and favors to a foreign government, in this particular case Turkey, behave… and the kinds of people they associate with. That modus operandi classically matches of the individuals I know who were serving Turkish government’s and other Turkish entities’ interest.” (Edmonds 8/8/2009, pp. 84-87)
Turkish Practices and Policies 'Inimical to American Interests' that Resulted in 'Lost Lives' - Edmonds is asked about a deposition-related declaration in which she stated that she had, “obtained evidence that the government of Turkey had engaged in practices and policies that were inimical to American interests and had, in fact, resulted in both the direct and indirect loss of American lives.” As examples, Edmonds refers to the setting up of Madrassahs in order to radicalize Muslims to be Mujahedeen and use them as proxies in conflicts and terrorism; trafficking in heroin; “illegally obtaining and selling” US military weapons and technology including nuclear secrets, as well as other top secret information, including foreign policy secrets; and the exposure of Brewster-Jennings as a CIA front company investigating nuclear trafficking (see Summer-Autumn 2001). (Edmonds 8/8/2009, pp. 88-94)
Fethullah Gulen, US-Protected Madrassah Financier - When asked who Fethullah Gulen (spelled Fetullah Gulan in the transcript) is, Edmonds states his network controlled around $25 billion and had set up 300 Madrassahs in Central Asia. She says he fled Turkey when Turkish authorities linked him to plans to overthrow the secular Turkish government, and he was permitted to enter and remain in the US without a visa. Edmonds states he is establishing Madrassah’s in the US that are allegedly moderate but are in fact radicalizing Muslims, and that Gulen is being protected by US authorities because US entities consider his network useful for waging proxy wars over Central Asian energy resources. As an analogy, Edmonds says the “Cold War is not over”. (Edmonds 8/8/2009, pp. 94-98) After Marino’s examination, Bruce Fein cross-examines Edmonds, then Marino re-examines and Fein cross-examines her again. The entire deposition lasts about four and a half hours. (Edmonds 8/8/2009, pp. 104-216)

Federal judge Emmet Sullivan rules that the FBI must publicly reveal information from its 2004 interview with then-Vice President Dick Cheney during the Valerie Plame Wilson leak investigation (see May 8, 2004). The information has been kept classified by both the Bush and Obama administrations, who have argued that future presidents, vice presidents, and their senior staff may not cooperate with criminal investigations if they know what they say could became public. Sullivan rules that there is no justification to withhold the FBI records of Cheney’s interview, since the leak investigation has long since concluded. Further, the idea that such a judgment may lead to future reluctance to cooperate with investigations is ‘incurably speculative’ and cannot affect his judgment. To rule in favor of the Bush and Obama administrations, Sullivan says, would be “breathtakingly broad” and “be in direct contravention of ‘the basic policy’ of” the Freedom of Information Act. He does allow some portions, affecting national security and private communications between Cheney and former President Bush, to be redacted. Those portions include details about Cheney’s talks with then-CIA Director George Tenet about Joseph Wilson’s trip to Niger (see February 21, 2002-March 4, 2002), talks with then-National Security Adviser Condoleezza Rice, discussions about Bush’s 2003 State of the Union address (see Mid-January 2003 and 9:01 pm January 28, 2003), discussions about how to respond to press inquiries about the leak of Plame Wilson’s identity, and Cheney’s involvement in declassification discussions. The Justice Department has previously indicated that it would appeal any ruling allowing the information of Cheney’s testimony to be made public. The declassification was sparked by a July 2008 lawsuit filed by the watchdog organization Citizens for Responsibility and Ethics in Washington (CREW), who filed a Freedom of Information Act request with the Justice Department seeking records related to Cheney’s interview in the investigation. In August, CREW sued for the records. CREW’s Melanie Sloan says the group hopes the Obama administration will reveal the entire record in the interest of transparency. “The American people deserve to know the truth about the role the vice president played in exposing Mrs. Wilson’s covert identity,” she says. “High-level government officials should not be permitted to hide their misconduct from public view.” (Pickler 10/1/2009; Gerstein 10/1/2009)

The progressive media watchdog Web site Media Matters releases the results of an analysis it has performed on Fox News’s claims to be an objective news provider. According to Media Matters, Fox News’s news reporting (as opposed to its commentary) is permeated with conservative slant, spin, and outright falsehoods. The Media Matters analysis, which restricts itself to material broadcast in 2009, is prompted by White House claims that Fox News is not an objective source of news, but a purveyor of Republican- and conservative-sourced propaganda (see October 11, 2009). Anchors Echoed False Health Care Claims - In February, Fox News anchors Bill Hemmer and Megyn Kelly echoed a false claim made by health care lobbyist Betsy McCaughey that a legislative provision in a Senate spending bill would empower the government to “dictate treatments” doctors can provide for patients (see February 9-10, 2009).
Anchor Echoed Republican Press Release So Closely that Typo Is Repeated - Also in February, Fox News anchor Jon Scott repeated the claims of a Senate Republican Communications Center press release so closely that the on-air graphics repeated a typographical error from the original document (see February 10, 2009). Scott did not acknowledge the source of the research, even after apologizing for the typo.
News Show Passed Off Seven-Month-Old Video Clip as New to Claim White House Hypocrisy - On March 15, Fox News anchor Martha MacCallum used video clips of Vice President Joseph Biden to falsely assert that the administration’s economic message had drastically changed since the election, from negative characterizations to positive assertions. MacCallum did not tell the audience that the clip of Biden was a seven-month-old clip from the presidential campaign, and that the words Biden was speaking were his characterization of Republican candidate John McCain’s perceptions (see March 16-17, 2009).
Anchor Promoted, Praised 'Tea Parties' - Several times in March and April, Hemmer, the host of Fox News’s flagship morning news broadcast America’s Newsroom, hosted segments promoting and praising the upcoming April 15 “tea party” protests (see March 23-24, 2009, April 6-7, 2009, and April 13-15, 2009).
Labeled GOP Op-Ed Claims as 'Facts' - On April 1, Scott repeated claims made by a Republican congressman in an editorial about the GOP’s “alternative budget” almost verbatim, but labelled them “facts” (see April 1, 2009).
Fox Repeated Discredited GOP Claims about Price of 'Cap-and-Trade' Proposal - On April 1 and 2, anchors Eric Shawn and Alisyn Camerota repeated a disproven claim that the Obama administration’s “cap-and-trade” emissions control proposal would cost American households over $3,000 per year. They did not report that the claim had been disproven (see April 1-6, 2009).
Obama Budget '4X Bigger' Than Bush Budgets - On April 3, Hemmer’s America’s Newsroom displayed an on-air “chyron” that falsely claimed President Obama’s 2010 budget proposal was four times larger than the largest budget submitted by former President Bush (see April 3, 2009).
News Anchors Promoted 'Tea Parties' - On April 15, Fox anchors joined opinion commentators in touting the day’s “tea party” protests (see April 15, 2009). The next day, Fox News anchor Megyn Kelly admitted that the network gave the protests “PR” coverage (see April 16, 2009).
Correspondent Used GOP Research to Criticize Democratic Spending - On April 23, Hemmer used research by Republican House Minority Whip Eric Cantor (R-VA) to “expose” several “wasteful” projects funded by the Democrats’ economic stimulus act, without revealing the source of the research to his audience (see April 23, 2009).
Correspondent Claimed Legislation Would Curb Religious Expression - On April 29, Fox News correspondent Molly Henneberg repeated disproven claims that a pending hate crimes bill would interfere with Americans’ right to religious expression (see April 29, 2009).
News Anchor Accused Democrats of Defending Pedophiles - On May 6, Hemmer falsely accused Congressional Democrats of voting to extend “hate crimes” protection to pedophiles (see May 5-6, 2009).
News Anchor Accused Supreme Court Nominee of 'Reverse Racism' - On May 26, Kelly misrepresented a remark by Supreme Court nominee Sonia Sotomayor to accuse her of “reverse racism” (see May 26, 2009).
Misleading Editing to Bolster Obama 'Apology Tour' Claim - On June 2, Fox anchors Scott and Jane Skinner aired selectively edited clips of a speech by Obama in France to falsely claim that the president had nothing but criticism for the US while in Europe. They then asked if Obama intended to embark on a second “apology tour” (see June 2, 2009). On July 30, The Live Desk guest host Gregg Jarrett told viewers that a recent decision by the Obama Justice Department may have meant that it was permissible for blacks to intimidate whites at the voting booth, but not the other way around (see July 30, 2009).
News Anchor Reported False Allegation of Criminal Activity by Obama Official - On October 1, Hemmer reported that Education Department official Kevin Jennings covered up the crime of statutory rape. The allegation had been disproven five years before (see September 28 - October 1, 2009). (Media Matters 10/13/2009)

US Special Operations and CIA paramilitary forces more than quadruple the number of clandestine kill or capture raids they carry out in Afghanistan. The secret teams carry out 90 raids in November as compared to 20 in May, according to US officials. The Los Angeles Times reports that top commander General Stanley McChrystal orders the change in US military strategy, which intensifies Special Operations missions and shifts away from hunting al-Qaeda leaders to targeting mid-level Taliban commanders. Black operations teams involved in the missions reportedly include the Army’s Delta Force and the Navy SEALs’ Team Six, working together with CIA paramilitary units. (Barnes 12/16/2009) These special units fall under the US military’s Joint Special Operations Command (JSOC), a secretive structure formerly headed by McChrystal (see May 11, 2009).

Las Vegas Review-Journal publisher Sherman Frederick falsely claims that “the two cases of domestic terrorism since 9/11” have taken place “on Obama’s watch.” In recent months, two former Bush administration officials have denied that 9/11 took place during the Bush presidency (see November 24, 2009 and December 27, 2009). The progressive media watchdog Web site Media Matters will write, “Frederick joins [the] list of conservatives denying existence of terrorist attacks under Bush.” Frederick writes: “If this is what it takes to wake up Obama to the evils of this world, then he learned an easy lesson. But tell that to the personnel who lost their lives to terrorism at Fort Hood [referring to the November 9, 2009 mass shooting at Fort Hood, Texas, perpetrated by a Muslim US Army psychiatrist with suspected ties to extremist groups]. Then, as now, the Obama administration fails to swiftly acknowledge the threat. They demur in describing our enemy as radical Muslims. They plan to close the offshore prison for terrorists at Guantanamo Bay and transfer the prisoners to the United States. They give the enemy combatants who killed more than 3,000 people on 9/11 the privilege of a civilian federal trial in New York City when a military tribunal is more appropriate. And for three days our president failed to address his people directly on Abdulmutallab’s failed effort to blow up a commercial flight over Detroit on Christmas Day [referring to Umar Farouk Abdulmutallab, who attempted to detonate an explosive device carried in his underwear on a Northwest Airlines flight—see December 25, 2009]. All of this on top of President Obama’s noticeable refusal to characterize our struggle as a ‘war’ on ‘terror.’ In the wake of fierce criticism, Obama now talks tough about keeping America safe. But in the two cases of domestic terrorism since 9/11—both on Obama’s watch—red flags flew aplenty.” Frederick either forgets or ignores a string of domestic terrorist attacks on US targets during the Bush presidency, including the 2001 anthrax attacks (see September 17-18, 2001, October 5-November 21, 2001, October 6-9, 2001, and October 15, 2001); the attempt to blow up a transatlantic plane by “shoe bomber” Richard Reid, who has ties to al-Qaeda (see December 22, 2001); the 2002 attack on the El Al ticket counter at Los Angeles International Airport, designated by the Justice Department as an official “act of international terrorism”; the 2002 sniper shootings in the Washington, DC, area, carried out by John Allen Muhammed, who was convicted of terrorism charges; and the 2006 attack on the University of North Carolina campus, where a Muslim student struck nine pedestrians in his SUV because, he said, he wanted to “avenge the deaths or murders of Muslims around the world.” (Media Matters 1/6/2010)

Former New York City Mayor Rudolph Giuliani, a 2008 contender for the Republican presidential nomination, tells an ABC audience that the US experienced “no domestic attacks” during the Bush administration. Giuliani is forgetting, or ignoring, the 9/11 attacks, the most lethal and costly terrorist attacks in US history, a curious omission considering Giuliani was mayor when two hijacked jetliners struck New York City’s World Trade Center buildings on September 11, 2001, eight months into the Bush administration. In recent months, two former Bush administration officials have also denied that 9/11 took place during the Bush presidency (see November 24, 2009 and December 27, 2009), as has a Nevada newspaper publisher just days ago (see January 3, 2010). Good Morning America host George Stephanopoulos begins by asking Giuliani about his opposition to trying suspected terrorists in civilian courts instead of in military tribunals (see November 13, 2001 and January 29, 2009). Giuliani asks “why stop” torturing suspects instead of putting them on trial, saying that the US may continue to get “good information” from them, presumably about plans for future terrorist attacks. Giuliani says that while Bush “didn’t do everything right” in the “war on terror,” what Obama “should be doing is following the right things [Bush] did. One of the right things he did was treat this as a war on terror, we had no domestic attacks under Bush, we had one under Obama.” Stephanopoulos notes that Obama has “stepped up” actions against terrorists, but does not correct Giuliani’s claim that the US “had no domestic attacks under Bush.” (Media Matters 1/8/2010)

WikiLeaks publishes a 2008 Pentagon report about itself. The report was recently leaked to WikiLeaks, but was drafted after WikiLeaks began publishing US Army information and analysed the apparent threat the organization posed to the Defense Department (see 2008). The Army confirms the document’s authenticity. WikiLeaks founder Julian Assange makes light of the report’s speculation that his organization is supported by the CIA. “I only wish they would step forward with a check if that’s the case,” he says. (Strom 3/17/2010)

(MovieWeb (.com) 7/21/2010) Actors Naomi Watts and Sean Penn portray Plame Wilson and her husband, Joseph Wilson; the movie is directed by noted action movie creator Doug Liman. Reviews of the movie are generally positive, though CNN reviewer Tom Charity says it fails to generate the same level of excitement that Liman’s earlier movies created, possibly because of the lack of intense action sequences. Charity says Watts makes for a “distinctly passive heroine,” with Penn “tak[ing] a more dynamic role as Wilson, refusing to back down and taking on the administration in a battle waged over the airwaves and in the op-ed pages of the nation’s newspapers.” Reviewer Joe Tyrell is more positive, calling Watts and Penn “top-flight.” Chicago Sun-Times reviewer Roger Ebert writes that the film “is unusually bold for a fictionalization based on real events. Using real names and a good many facts, it argues: (1) Saddam Hussein had no WMD; (2) the CIA knew it; (3) the White House knew it; (4) the agenda of Cheney and his White House neocons required an invasion of Iraq no matter what, and (5) therefore, the evidence was ignored and we went to war because of phony claims. Well. That’s what the film says. There will no doubt be dissent. Few people are happy to be portrayed as liars and betrayers. What amazes me is that Fair Game doesn’t play the game of using fictional names. They’re all right there, including Cheney personally ordering the intelligence to be falsified.” Charity writes, “The movie becomes a portrait of a marriage splintering under extraordinary outside pressure, a study in self-righteous male pride running afoul of a mother’s anxiety for the safety and well-being of her children,” and chides the outspokenly progressive Penn for portraying a character “so close to [his] public persona.” The entire film, Charity writes, is “workmanlike, earnest but a little dry and predictable. Perhaps we’ve become inured to government corruption since the heyday of the conspiracy thrillers of the 1970s, but at this stage the film’s ‘revelations’ about the propaganda war that pre-sold the Iraq invasion will come as old news to anyone who’s been paying even the slightest attention. A more challenging and relevant movie might have focused on Scooter Libby and probed the convictions that drove him to obstruct justice and commit perjury.” Tyrell praises David Andrew’s portrayal of Libby, noting that he catches Libby’s persona “down to the last oily drop.” (Ebert 11/3/2010; Charity 11/5/2010; Tyrell 11/13/2010) Ebert concludes: “This isn’t a lathering, angry attack picture. Wilson and Plame are both seen as loyal government employees, not particularly political until they discover the wrong information. The implication is that if the Bush administration hadn’t suppressed their information and smeared them, there might have been no Iraq war, and untold thousands of lives would have been saved. This topic has been so poisoned by misinformation that a rational discussion seems impossible. I suppose the question becomes, how well does Fair Game work as a movie? I suspect it will work better the more you walk in agreeing with it.” (Ebert 11/3/2010)

Roger Ailes, a powerful Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988) and the founder and chairman of Fox News (see October 7, 1996), calls President Obama a “socialist,” and says the campaign contributions by Fox News’s parent company are legal and ethical. Of Obama, Ailes says: “The president has not been very successful. He just got kicked from Mumbai to South Korea, and he came home and attacked Republicans for it. He had to be told by the French and the Germans that his socialism was too far left for them to deal with.… He just has a different belief system than most Americans.” Fox News does not “single out” Obama for criticism, Ailes claims, but is merely “more direct” in its reporting. Ailes says Fox is correct in painting Obama as an anti-American who harbors secret sympathies for Islamist terrorists; it is the other news outlets that fear to report the “truth.” Most of the press is “in love” with Obama, he says. Ailes says Fox’s ratings boost since the Obama election (see November 4, 2008) has nothing to do with the network’s relentless criticism of Obama and the White House. Fox currently leads both of its cable news competitors, CNN and MSNBC, in ratings. He says that he was “totally surprised” when Fox News’s parent, News Corporation (often abbreviated NewsCorp), donated $2 million to Republican campaign organizations (see June 24, 2010 and After and September 30, 2010), but says NewsCorp owner Rupert Murdoch has the right to donate money to whichever organization or candidate he chooses. As for criticism of the donations, Ailes says he knew that “lefties would use it to immediately try to damage Fox News.” (Kurtz 11/16/2010) Fox News commentators and hosts have frequently tarred Obama and his advisors as socialists, “Stalinists,” and “Marxists” (see October 27, 2008, January 2009, March 17, 2009, March 29, 2009, April 1-2, 2009, May 13, 2009, May 28, 2009, September 1, 2009, January 27, 2010, May 19, 2010, September 18, 2010, September 29, 2010, and October 26, 2010).

US Vice President Joseph Biden calls Wikileaks founder Julian Assange a “high-tech terrorist” on NBC’s Meet the Press. The interview was taped two days previously, but is broadcast on this day. Asked if he sees Assange as closer to a hi-tech terrorist than the whistleblower who released the Pentagon Papers (see March 1971) in the 1970s, Biden replies: “I would argue it is closer to being a hi-tech terrorist than the Pentagon Papers. But, look, this guy has done things that have damaged and put in jeopardy the lives and occupations of people in other parts of the world.” Biden adds: “He’s made it more difficult for us to conduct our business with our allies and our friends. For example, in my meetings—you know I meet with most of these world leaders—there is a desire now to meet with me alone, rather than have staff in the room. It makes things more cumbersome—so it has done damage.” Asked if the administration could prevent further leaks, Biden comments, “The Justice Department is taking a look at that.” Biden goes on to suggest that if Assange facilitated the leak of the documents by colluding with the whilstleblower who provided them, thought to be former intelligence analyst Bradley Manning, he could be open to prosecution. “If he conspired to get these classified documents with a member of the US military that is fundamentally different than if someone drops on your lap… you are a press person, here is classified material.” Biden’s comments show an increased level of annoyance in the administration with Wikileaks. For example, the day before this interview was taped, Biden had expressed different sentiments. “I don’t think there’s any substantive damage,” he had commented then. (MacAskill 12/19/2010)

A person described as a “former Fox News insider” tells author and Media Matters columnist Eric Boehlert that Fox News is indeed “a propaganda outfit” calling itself a news provider. In an interview, the source tells Boehlert that Fox routinely reports false information to “prop up Republicans and knock down Democrats,” and calls the news channel a “purely partisan operation” that actively spins almost every news story to reflect a Republican/conservative slant (see November 3, 2003, April 1, 2009, April 1-6, 2009, and April 23, 2009). “I don’t think people would believe it’s as concocted as it is,” the source says; “that stuff is just made up (see February 14, 2003).… It is their MO to undermine the [Obama] administration and to undermine Democrats (see December 2002, January 2009, February 24, 2009, April 3, 2009, and August 11, 2009). They’re a propaganda outfit but they call themselves news” (see 1995, January 20, 2003, and July 2004). Boehlert says that “[e]veryone knows” Fox News has always reported news with a conservative slant: “Everyone who’s been paying attention has known that since the channel’s inception more than a decade ago” (see October 7, 1996). But over time, Boehlert writes, Fox News has become “an open and active political player, sort of one-part character assassin and one-part propagandist, depending on which party was in power.” The source confirms Boehlert’s observation, saying: “They say one thing and do another. They insist on maintaining this charade, this facade, that they’re balanced or that they’re not right-wing extreme propagandist[s].” The facade is one that, Boehlert writes, “permeates the entire Fox News culture and one that staffers and producers have to learn quickly in order to survive professionally.” The source says: “You have to work there for a while to understand the nods and the winks. And God help you if you don’t because sooner or later you’re going to get burned.” Virtually every hard-news story is presented in a way that either bolsters conservative ideology, criticizes liberal/progressive ideology, or both. “[A]nything—anything—that was a news story you had to understand what the spin should be on it,” the source says. “If it was a big enough story it was explained to you in the morning [editorial] meeting. If it wasn’t explained, it was up to you to know the conservative take on it. There’s a conservative take on every story no matter what it is. So you either get told what it is or you better intuitively know what it is” (see June 8, 2004). The source says with some apparent sarcasm: “My internal compass [on ‘spinning’ a story] was to think like an intolerant meathead. You could never error on the side of not being intolerant enough.”
Spin Training - The source reflects on how Fox News executives trained its employees to “spin” news stories, saying: “When I first got there back in the day, and I don’t know how they indoctrinate people now, but back in the day when they were ‘training’ you, as it were, they would say, ‘Here’s how we’re different.’ They’d say if there is an execution of a condemned man at midnight and there are all the live truck outside the prison and all the lives shots. CNN would go, ‘Yes, tonight John Jackson, 25 of Mississippi, is going to die by lethal injection for the murder of two girls.’ MSNBC would say the same thing. We would come out and say, ‘Tonight, John Jackson who kidnapped an innocent two-year-old, raped her, sawed her head off, and threw it in the school yard, is going to get the punishment that a jury of his peers thought he should get.’ And they say that’s the way we do it here. And you’re going, alright, it’s a bit of an extreme example but it’s something to think about. It’s not unreasonable.”
Changed over Time - Fox News officials always insisted that they were serving as “a bit of a counterpart to the screaming left wing lib media,” the source says. “So automatically you have to buy into the idea that the other media is howling left-wing. Don’t even start arguing that or you won’t even last your first day.” However, things have changed since the source first joined Fox: “For the first few years it was let’s take the conservative take on things. And then after a few years it evolved into, well it’s not just the conservative take on things, we’re going to take the Republican take on things which is not necessarily in lock step with the conservative point of view. And then two, three, five years into that it was, ‘We’re taking the Bush line on things,’ which was different than the GOP. We were a Stalin-esque mouthpiece. It was just what Bush says goes on our channel. And by that point it was just totally dangerous. Hopefully most people understand how dangerous it is for a media outfit to be a straight, unfiltered mouthpiece for an unchecked president.” As time went on, the source says, the news reporting became ever more strident and more partisan.
Siege Mentality - Using the source’s descriptions, Boehlert describes it as an “us-vs.-them mentality… a siege mentality that network boss Roger Ailes encourages, and one that colors the coverage his team produces.” The source confirms Boehlert’s observation, saying: “It was a kick-_ss mentality too. It was relentless and it never went away. If one controversy faded, godd_mn it they would find another one. They were in search of these points of friction real or imagined. And most of them were imagined or fabricated. You always have to seem to be under siege. You always have to seem like your values are under attack. The brain trust just knew instinctively which stories to do, like the War on Christmas” (a seasonal series of stories by Fox commentator Bill O’Reilly and others that regularly claim liberals, progressives, and the like “hate Christmas” and want to see it “destroyed”). It is rare for former Fox employees such as the source to share “insider” information after leaving, in part because of a strict non-disclosure agreement each exiting employee is asked to sign, and in part because of Ailes’s “siege mentality.” The source says that Ailes is bent on presenting a “unified Fox News front to the outside world,” to the point where he refuses to publicly criticize or critique other Fox employees regardless of how unprofessionally or even outlandishly they may behave on the air (see April 1, 2003, February 3-4, 2005, September 28-October 1, 2005, March 6, 2007, June 4-5, 2008, June 26, 2008, February 9-10, 2009, February 10, 2009, February 20, 2009, March 3, 2009, March 16-17, 2009, March 17-24, 2009, March 25, 2009, April 15, 2009, May 5-6, 2009, May 26, 2009, May 28, 2009, July 8, 2009, July 17, 2009, July 23, 2009, July 27, 2009, July 28-29, 2009, August 8, 2009, August 10, 2009, August 11, 2009, August 11, 2009, September 29, 2009, November 3, 2009, March 24, 2010, and October 3, 2010). The source says: “There may be internal squabbles. But what [Ailes] continually preaches is never piss outside the tent. When he gets really crazy is when stuff leaks out the door. He goes mental on that. He can’t stand that. He says in a dynamic enterprise like a network newsroom there’s going to be in fighting and ego, but he says keep it in the house.”
Evidence Bolsters Source's Claims - Boehlert notes that along with the source’s contentions, a great deal of evidence surfaced in 2010 that showed Fox News to be deliberately propagandistic in its reporting (see March 13, 2009 and After, March 23-24, 2009, April 6-7, 2009, April 6-13, 2009, April 15, 2009, April 16, 2009, May 13-14, 2009, June 2, 2009, July 28, 2009, July 30, 2009, August 7, 2009, August 28, 2009, September 1, 2009, September 12, 2009, September 18, 2009, and November 5-8, 2009). He cites the recently leaked emails from inside Fox News in which a senior editor instructed his newsroom staffers to slant the news when reporting on issues such as climate change and health care reform (see October 27, 2009 and After and December 8, 2009 and After); the over 600 instances of Fox News personalities raising money, endorsing, and actively campaigning for Republican candidates and/or organizations; and the over $1 million donated by Fox News owner Rupert Murdoch to organizations dedicated to electing Republicans (see June 24, 2010 and After and September 30, 2010). Boehlert says that according to Media Matters estimates, Fox News has in essence donated $55 million worth of free airtime to Republican presidential hopefuls who also work for Fox News (see October 26, 2009). The source says Fox News is anything but a legitimate news outlet, and says both the Washington press corps and the general public has been duped by Murdoch’s relentless “fair and balanced” marketing campaign over the years. “People assume you need a license to call yourself a news channel,” the source says. “You don’t. So because they call themselves Fox News, people probably give them a pass on a lot of things.… I don’t think people understand that it’s an organization that’s built and functions by intimidation and bullying, and its goal is to prop up and support Republicans and the GOP and to knock down Democrats. People tend [to] think that stuff that’s on TV is real, especially under the guise of news. You’d think that people would wise up, but they don’t.”
Source Critical of Other News Outlets for Not Criticizing Fox News - The source is harshly critical of other news outlets, including their reporters and pundits, for failing to criticize Fox News for its propaganda. The source explains: “They don’t have enough staff or enough balls or don’t have enough money or don’t have enough interest to spend the time it takes to expose Fox News. Or it’s not worth the trouble. If you take on Fox, they’ll kick you in the _ss. I’m sure most [journalists] know that.” Boehlert notes that journalists who have criticized Fox News have come under heavy fire from Fox News (see November 17-18, 2010). The source says he/she was perplexed in 2009, when Obama administration officials questioned Fox News’s legitimacy as a news source (see September 18-19, 2009 and October 11, 2009), only to have Washington press corps figures rush to Fox’s defense. “That blew me away,” the source says. The White House’s critique of Fox News “happens to be true” (see October 17, 2009). (Boehlert 2/10/2011)

[Source: Huffington Post]New York Magazine reporter Gabriel Sherman profiles Fox News chairman Roger Ailes (see October 7, 1996), who also serves as a Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988). According to close friends and advisers to Ailes interviewed by Sherman, Ailes wants far more than the continued ratings and advertiser success of Fox News—he wants the network to steer one of its own into the White House in 2012 (see October 2008). He is tremendously influential; a Republican strategist tells Sherman: “You can’t run for the Republican nomination without talking to Roger. Every single candidate has consulted with Roger.”
Letdown? - Ailes has been keenly disappointed in the results of his network’s official and unofficial candidates so far. Former Alaska governor and Fox commentator Sarah Palin (see September 15-16, 2010), who has not yet announced her candidacy for the Republican presidential nomination, is polling at around 12 percent among Republican voters. Official presidential candidates Newt Gingrich, the former speaker of the House, and Rick Santorum, a former senator, who both are commentators for Fox, have even lower numbers, at 10 percent and 2 percent respectively. Ailes has asked Governor Chris Christie (R-NJ), who is not a Fox employee, to run; until recently, Fox News was enthusiastically promoting the putative presidential run of billionaire “birther” Donald Trump (see March 17, 2011). Ailes has envisioned General David Petraeus as a potential candidate, but Petraeus has instead accepted the post of CIA director. “He thinks things are going in a bad direction,” says a Republican close to Ailes. “Roger is worried about the future of the country. He thinks the election of [President] Obama is a disaster.” None of the current crop of candidates meets Ailes’s expectations. Ailes is particularly disappointed in Palin; according to the same Republican, Ailes considers her “an idiot”: “He thinks she’s stupid. He helped boost her up. People like Sarah Palin haven’t elevated the conservative movement.” After Democratic Representative Gabrielle Giffords was shot in January 2011, and other media outlets focused on Palin’s use of gunsight graphics to “target” Giffords and other vulnerable Democrats in the 2010 election (see March 24, 2010), according to Sherman, “Ailes recognized that a Fox brand defined by Palin could be politically vulnerable.” After the Giffords shooting, Ailes told an interviewer, “I told all of our guys, ‘Shut up, tone it down, make your argument intellectually.’” Ailes was infuriated when Palin refused his advice to remain quiet until after the memorial service, and accused her critics of committing “blood libel,” a phrase often seen as anti-Semitic. The problem with Palin was further exacerbated when she argued about the amount of work Fox expects her to do: she does not want to host special broadcasts or other tasks the network expects of her. In March 2011, Fox suspended the contracts of Gingrich and Santorum so they could run their campaigns without legal or ethical entanglements. Shortly thereafter, Huckabee chose to remain at Fox and abandon his plans for a primary challenge. The network is still waiting for Palin’s decision whether to run for president.
Creation of the Tea Party - While Ailes and Fox News did not directly create the “tea party” “grassroots” movement, Ailes was involved in its creation and promotion from its outset (see February 19, 2009, February 27, 2009, and April 15, 2009). Ailes has always been somewhat leery of having Fox News too closely associated with the burgeoning movement (see March 13, 2009 and After, March 23-24, 2009, April 2, 2009, April 6-7, 2009, April 6-13, 2009, April 8, 2009, April 13-15, 2009, April 15, 2009, April 15, 2009, April 16, 2009, May 13-14, 2009, July 28, 2009, August 3, 2009, August 28, 2009, September 12, 2009, and September 12, 2010), and at one point banned Fox News host Sean Hannity from hosting a tea party rally. However, according to Sal Russo, a former Reagan aide and the founder of the national Tea Party Express tour, “There would not have been a tea party without Fox.” Fox News has promoted a number of successful “tea party” candidates (see May 14, 2008 - February 2010), including former host John Kasich (see March 27, 2008 - June 1, 2009 and After), who won the Ohio gubernatorial election in 2010. Before that election, Gingrich, still a Fox News commentator at the time, said that he was confident the “tea party” would evolve into “the militant wing of the Republican Party” (see April 21, 2010). Ailes used some of the same “astroturf” tactics (see February 27, 2009 and April 14, 2009) in developing the “tea party” as he did when he represented tobacco companies such as R.J. Reynolds, creating phony, seemingly independent “front” groups to push the “tea party” messages in the media. (Sherman 5/22/2011)

Fox News chief Roger Ailes acknowledges that Fox News has undergone what he calls a “course correction” over the last year, dialing back some of the most inflammatory and partisan rhetoric that is its brand. The release of talk show host Glenn Beck (see March 28 - April 6, 2011) is one of the actions Ailes has taken to “moderate” Fox News’s stance, as is the lower profile given former Alaska Governor Sarah Palin as a prominent Fox personality—once aggressively promoted by the network as the savior of the Republican Party, Palin is much less visible on the network now. Ailes has ordered the opinion show hosts such as Sean Hannity and Bill O’Reilly to tone down the rhetoric, in part in response to the shooting of Representative Gabrielle Giffords (D-AZ) and the resultant debate about the aggressive, violent rhetoric being promulgated on the right (see March 24, 2010). Moreover, as media pundit Howard Kurtz writes, “[i]t was, in his view, a chance to boost profits by grabbing a more moderate audience.” Ailes’s contract is up in 2013, and some expect the 71-year-old media magnate not to renew his contract thereafter. Ailes continues to insist that his news network is the only “fair and balanced” (see 1995) news outlet on television, with the other broadcast and cable news providers being relentlessly liberal in their presentations, but on the other hand implicitly admits that he routinely pushes right-wing memes and talking points on his network. Today, for example, he is touting Fox News’s new “Regulation Nation” series, pushing the idea that government regulations have a stranglehold on American business. “[N]o other network will cover that subject,” he says. “I think regulations are totally out of control.” Government bureaucrats hire Ph.D.s to “sit in the basement and draw up regulations to try to ruin your life,” he says. Under Ailes’s direction, Fox News will feature stories on “over-regulation” in many of its straight-news and opinion shows. Some non-Fox News conservative pundits, such as radio host Rush Limbaugh, wonder if Ailes hasn’t given up on his commitment to conservative principles in return for ratings, saying, “Fox wants these people [Republican primary candidates] to tear each other up, ‘cause they want approval from the mainstream media.” Kurtz says that Ailes has turned the Republican primary into his own “reality show” for ratings and profits, essentially agreeing with Limbaugh. Overall, others are registering that Ailes is attempting to dial back the hyperpartisan posturing, even former Obama administration aide Anita Dunn, who says, “You have the sense that they’re trying to at least appear less of the hyperpartisan political network they had been.” (Kurtz 9/25/2011)

[Source: Premiere Radio Networks]Premiere Radio Networks, the company that distributes radio shows by an array of right-wing hosts, including Rush Limbaugh, announces that 98 out of 350 advertisers, including a number of major corporations, have requested that their ads only appear on “programs free of content that you know are deemed to be offensive or controversial (for example, Mark Levin, Rush Limbaugh, Tom Leykis, Michael Savage, Glenn Beck, Sean Hannity).” The Premiere email says, “Those are defined as environments likely to stir negative sentiment from a very small percentage of the listening public.” Limbaugh vilified law student Sandra Fluke for three days on his radio show (see February 29, 2012, March 1, 2012, and March 2, 2012), and though he issued an apology on his Web site (see March 3, 2012), advertisers have dropped their sponsorship of his show in increasingly large numbers (see March 2, 2012 and After) following a widespread outcry of anger against Limbaugh’s rhetoric. Now, large advertisers such as Ford, General Motors, Toyota, Allstate, Geico, Prudential, State Farm, McDonald’s, and Subway Restaurants have asked that their advertising be removed from Premiere’s right-wing talk shows. Industry insider Valerie Geller tells a reporter: “I have talked with several reps who report that they’re having conversations with their clients, who are asking not to be associated with specifically polarizing controversial hosts, particularly if those hosts are ‘mean-spirited.’ While most products and services offered on these shows have strong competitors, and enjoy purchasing the exposure that many of these shows and hosts can offer, they do not wish to be ‘tarred’ with the brush of anger, or endure customer anger, or, worse, product boycotts.” For nearly two decades, Limbaugh has been at the forefront of the movement that insisted conservative talk shows on radio and television must counterbalance what he and others have termed the “liberal bias” of the mainstream media (see Summer 1970, October 7, 1996, October 9, 2002, October 8, 2003, December 2004, December 14, 2005, December 19-20, 2005, December 21, 2005, May 2008, October 23-24, 2008, February 24, 2009, and August 11, 2009). After cable television and Internet access fragmented the market, “niche” audiences such as Limbaugh’s have provided the most reliable listenership and viewers, and the highest comparative ratings. However, the demographics are changing for right-wing talk. Limbaugh, Levin, Savage, Hannity, and others generally rate best among aging white males, a demographic that is less profitable than it used to be. Now, the prize advertising demographic is women aged 24 to 55, a demographic that has been leaving the right-wing talkers in steadily increasing numbers, and now makes up the forefront of the angry pushback against Limbaugh over his public savaging of a young female law student over a political disagreement. Some, including Limbaugh’s brother, right-wing talk show host David Limbaugh, have complained of a “left-wing jihad” against conservative radio hosts. However, as reporter John Avlon writes: “[T]he irony is that the same market forces that right-wing talk-radio hosts champion are helping to seal their fate. Advertisers are abandoning the shows because they no longer want to be associated with the hyperpartisan—and occasionally hateful—rhetoric. They are finally drawing a line because consumers are starting to take a stand.” Moreover, the advent of social media has made the response time for protesters and angry consumers almost immediate. Geller says: “In the past, a letter, petition, or phone campaign took a few days to put together and longer to execute. But now customers [listeners] can instantly rally using Facebook, Twitter, and instant messaging to make their displeasure with a client, product, or service known immediately. These movements can happen fast.” Avlon concludes: “When big money starts shifting, it is a sign of a deeper tide that is difficult to undo, even if you are an industry icon like Rush Limbaugh. It is a sign that the times are changing. Let’s hope that what emerges is an evolution of the industry, away from stupid, predictable, and sometimes hateful hyperpartisanship and toward something a little smarter and more civil.” (Radio-Info.com 3/9/2012; Avlon 3/10/2012)

[Source: Getty Images / CNN]Journalist Ari Berman, of the liberal magazine The Nation, writes that presumptive Republican presidential Mitt Romney (R-MA) seems to be relying on a large number of neoconservatives to help him formulate his foreign policy stance for the election. Berman believes it is safe to assume that Romney will appoint many of his neoconservative advisors to powerful positions in his administration should he win the November election. Berman writes: “Given Romney’s well-established penchant for flip-flopping and opportunism, it’s difficult to know what he really believes on any issue, including foreign affairs (the campaign did not respond to a request for comment). But a comprehensive review of his statements during the primary and his choice of advisers suggests a return to the hawkish, unilateral interventionism of the George W. Bush administration should he win the White House in November.” Conservative Christian leader Richard Land has said that Romney could shore up his sagging credibility with conservatives by “pre-naming” some key Cabinet selections: former Senator Rick Santorum (R-PA) as Attorney General, former House Speaker Newt Gingrich (R-GA) as US ambassador to the United Nations, and former State Department official John Bolton as Secretary of State. Berman calls the prospect of those appointments “terrifying” and “more plausible than one might think.” Neoconservative blogger Jennifer Rubin recently wrote for the Washington Post that “[m]any conservatives hope” Bolton will accept “a senior national security post in a Romney administration.” For his point, Bolton has endorsed Romney, and has campaigned on his behalf. Romney is not well versed in foreign policy affairs, Berman writes, noting that in 2008 the presidential campaign of John McCain (R-AZ) found that at the time “Romney’s foreign affairs resume is extremely thin, leading to credibility problems.” Romney suffered the criticism of being “too liberal” in 2008, and in 2011-12 attempted to refute that criticism by publicly aligning himself with Bolton and other neoconservatives. Brian Katulis of the liberal Center for American Progress has said, “When you read the op-eds and listen to the speeches, it sounds like Romney’s listening to the John Bolton types more than anyone else.” (Rucker 3/13/2012; Berman 5/21/2012)
The Project for the New American Century - Bolton and seven other Romney advisors are signers of a letter drafted by the Project for the New American Century (PNAC), an influential neoconservative advocacy group (see June 3, 1997 and September 2000) that urged both the Clinton and Bush administrations to attack Iraq (see January 26, 1998, February 19, 1998 and May 29, 1998). (The PNAC is defunct, but was replaced by a similar advocacy group, the Foreign Policy Initiative, or FPI—see Before March 25, 2009). PNAC co-founder Eliot Cohen, who served as counsel for Secretary of State Condoleezza Rice from 2007-2009, wrote the foreward to Romney’s foreign policy white paper, entitled “An American Century.” Cohen has called the war on terror “World War IV” (see November 20, 2001), and helped push the Bush administration into going to war with Iraq after the 9/11 bombings. In 2009, Cohen reiterated his 2001 call for the US to overthrow the government of Iran (see November 20, 2001). Another PNAC co-founder, FPI’s Robert Kagan, a longtime advocate for widespread war in the Middle East (see October 29, 2001), helped Romney formulate his foreign policy. Romney’s foreign policy stance is based largely on negative attacks on the Obama administration, which it accuses of kowtowing to foreign governments, and a massive military buildup. Bush Administration Officials' Involvement - Many former Bush administration officials are involved with Romney’s foreign policy. Robert G. Joseph, a former National Security Council official who is primarily responsible for having then-President Bush claim that Iraq had tried to buy enriched uranium from Niger (see January 26 or 27, 2003), former Bush administration spokesman and FPI founder Dan Senor (see October 2, 2005), and former Defense Department official Eric Edelman (see July 16-20, 2007) are prominent members of Romney’s advisory team. Preble says of Romney’s foreign policy advisors: “I can’t name a single Romney foreign policy adviser who believes the Iraq War was a mistake. Two-thirds of the American people do believe the Iraq War was a mistake. So he has willingly chosen to align himself with that one-third of the population right out of the gate.” Edelman, like others on the Romney team, believes that the US should attack Iran, a position Romney himself apparently holds. Senor serves as a conduit between the Romney campaign and Israel’s far right, including Prime Minister Benjamin Netanyahu. Recently, Senor posted the following on Twitter: “Mitt-Bibi will be the new Reagan-Thatcher.” Lawrence Wilkerson, the chief of staff for then-Secretary of State Colin Powell, has said the Republican Party “has not a clue” how to extricate the US from its “state of interminable war,” and apparently little appetite for such extrication. “In fact, they want to deepen it, widen it and go further, on Chinese and Japanese dollars.” The influence of far-right neoconservatives “astonishe[s]” Wilkerson. Christopher Preble, a foreign policy expert for the Cato Institute, says that neoconservatives have remained influential even after the Iraq debacle because they have rewritten history. “They’ve crafted this narrative around the surge (see January 10, 2007), claiming Iraq was, in fact, a success. They’ve ridden that ever since.”
Huge Spending Increases for Defense, Possible Recession - If Romney follows his current statements, a Romney administration under the tutelage of his neoconservative advisors would usher in a new era of massive defense spending increases. He advocates spending a minimum of 4 percent of the nation’s GDP (Gross Domestic Product) to increase spending on defense, which would increase the Pentagon’s budget by over $200 billion in 2016. That is 38% more than the Obama administration plans to spend on defense. Romney would pay for that increase with severe cuts in domestic spending. Fiscal Times columnist Merrill Goozner has written: “Romney’s proposal to embark on a second straight decade of escalating military spending would be the first time in American history that war preparation and defense spending had increased as a share of overall economic activity for such an extended period. When coupled with the 20 percent cut in taxes he promises, it would require shrinking domestic spending to levels not seen since the Great Depression—before programs like Social Security, Medicare and Medicaid began.” Goozner wrote that Romney’s spending plan “would likely throw the US economy back into recession.” The proposed huge spending increases are in part the product of the Defending Defense coalition, a joint project of the FPI, the American Enterprise Institute (AEI), and the Heritage Foundation. Cofer Black and Enhanced National Security - Romney’s counterterrorism advisor is J. Cofer Black, a former CIA operative and Bush-era security official. Black presented a plan to invade Afghanistan two days after the 9/11 attacks, and claimed that al-Qaeda could be defeated and the world made secure from terrorism in a matter of weeks (see September 13, 2001). Black was fired from the CIA in 2002 for publicly criticizing the Bush administration’s failure to capture or kill Osama bin Laden (see May 17, 2002). In 2005, Black became a senior official for the private mercenary firm Blackwater (see February 2005). He has been a Romney advisor since 2007 (see April 2007). Black advised Romney not to consider waterboarding as torture, and has touted his CIA experience with that agency’s illegal “extraordinary rendition” program, which sent prisoners to foreign countries for abuse and torture. Romney relies on Black for security assessments of security assessments of Afghanistan, Pakistan, Egypt and Iran, including Iran’s nuclear program. Preble says, “Romney’s likely to be in the mold of George W. Bush when it comes to foreign policy if he were elected.” Berman writes that “[o]n some key issues, like Iran, Romney and his team are to the right of Bush.” Berman goes on to write that if Romney adheres to his statements on the campaign trail, “a Romney presidency would move toward war against Iran; closely align Washington with the Israeli right; leave troops in Afghanistan at least until 2014 and refuse to negotiate with the Taliban; reset the Obama administration’s ‘reset’ with Russia; and pursue a Reagan-like military buildup at home.”
Moderates Sidelined - The moderates on Romney’s team have been shunted aside in favor of the hardliners. Mitchell Reiss, Romney’s principal foreign policy advisor in 2008 and a former State Department official under Powell, no longer enjoys favored access to the candidate. In December 2011 Romney publicly contradicted Reiss’s advocacy of US negotiations with the Taliban, instead advocating the total military defeat of the Taliban and criticizing the Obama administration’s plan to “draw down” US troops from Afghanistan. Vice President Joseph Biden has said that Romney and his neoconservative advisors “see the world through a cold war prism that is totally out of touch with the realities of the twenty-first century.” Romney began tacking to the right during the early days of the Republican primaries, aligning himself with candidates such as Gingrich, Herman Cain (R-GA), and Michele Bachmann (R-MN), and away from moderate candidate Jon Huntsman (R-UT) and isolationist candidate Ron Paul (R-TX). Heather Hurlburt of the centrist National Security Network says: “The foreign policy experts who represent old-school, small-c conservatism and internationalism have been pushed out of the party. Who in the Republican Party still listens to Brent Scowcroft?” (see October 2004). Wilkerson says moderate conservatives such as Powell and Scowcroft are “very worried about their ability to restore moderation and sobriety to the party’s foreign and domestic policies.” Berman writes, “In 2012 Obama is running as Bush 41 and Romney as Bush 43.” (Berman 5/21/2012)

Investigative journalist Robert Parry speaks at a conference in Heidelberg, Germany concerning the progression of journalism from the 1970s to the present. Parry tells the gathering that American investigative journalism may have hit something of a zenith in the 1970s, with the media exposure of the Pentagon Papers (see March 1971) and the Watergate scandal (see August 8, 1974). “That was a time when US journalism perhaps was at its best, far from perfect, but doing what the Founders had in mind when they afforded special protections to the American press,” he says. “In the 1970s, besides the Pentagon Papers and Watergate, there were other important press disclosures, like the My Lai massacre story and the CIA abuses—from Iran to Guatemala, from Cuba to Chile. For people around the world, American journalism was the gold standard. Granted, that was never the full picture. There were shortcomings even in the 1970s. You also could argue that the US news media’s performance then was exceptional mostly in contrast to its failures during the Cold War, when reporters tended to be stenographers to power, going along to get along, including early in the Vietnam War.” However, those days are long past, Parry notes, and in recent years, American journalism has, he says, gone “terribly wrong.” Parry says that the American press was subjected to an orchestrated program of propaganda and manipulation on a par with what the CIA did in many foreign countries: “Think how the CIA would target a country with the goal of shoring up a wealthy oligarchy. The agency might begin by taking over influential media outlets or starting its own. It would identify useful friends and isolate troublesome enemies. It would organize pro-oligarchy political groups. It would finance agit-prop specialists skilled at undermining and discrediting perceived enemies. If the project were successful, you would expect the oligarchy to consolidate its power, to get laws written in its favor. And eventually the winners would take a larger share of the nation’s wealth. And what we saw in the late 1970s and early 1980s in the United States was something like the behavior of an embattled oligarchy. Nixon’s embittered allies and the Right behaved as if they were following a CIA script. They built fronts; they took over and opened new media outlets; they spread propaganda; they discredited people who got in the way; ultimately, they consolidated power; they changed laws in their favor; and—over the course of several decades—they made themselves even richer, indeed a lot richer, and that, in turn, has translated into even more power.”
Building a Base - Right-wing billionaires such as the Koch brothers (see 1979-1980) and Richard Mellon Scaife, along with Nixon-era figures such as former Treasury Secretary William Simon (a Wall Street investment banker who ran the right-wing Olin Foundation) worked to organize conservative foundations; their money went into funding what Parry calls “right-wing media… right-wing think tanks… [and] right-wing attack groups. Some of these attack groups were set up to go after troublesome reporters.” Parry finds it ironic, in light of the CIA’s interference in the affairs of other nations, that two foreign media moguls, Sun Myung Moon and Rupert Murdoch, were key figures in building and financing this conservative media construct. Some media outlets, such as Fox News (see Summer 1970 and October 7, 1996), were created from scratch, while others, such as the venerable and formerly liberal New Republic, were bought out and taken over by conservatives. When Ronald Reagan ascended to the White House, Parry says, he brought along with him “a gifted team of [public relations] and ad men.” Vice President George H.W. Bush, a former CIA director, enabled access to that agency’s propaganda professionals. And Reagan named William Casey to head the CIA; Casey, a former Nixon administration official, was “obsessed [with] the importance of deception and propaganda,” Parry says. “Casey understood that he who controlled the flow of information had a decisive advantage in any conflict.”
Two-Pronged Attack - Two key sources of information for Washington media insiders were targeted, Parry says: the “fiercely independent” CIA analytical division, whose analyses had so often proven damaging to White House plans when reported, and the “unruly” Washington press corps. Casey targeted the CIA analysts, placing his young assistant, Robert Gates, in charge of the analytical division; Gates’s reorganization drove many troublesome analysts into early retirement, to be replaced with more malleable analysts who would echo the White House’s hard line against “Soviet expansionism.” Another Casey crony, Walter Raymond Jr., worked to corral the Washington press corps from his position on the National Security Council. Raymond headed an interagency task force that ostensibly spread “good news” about American policies in the foreign press, but in reality worked to smear and besmirch American journalists who the White House found troubling. According to Parry, “Secret government documents that later emerged in the Iran-Contra scandal revealed that Raymond’s team worked aggressively and systematically to lobby news executives and turn them against their reporters when the reporters dug up information that clashed with Reagan’s propaganda, especially in hot spots like Central America.” It was easy to discredit female journalists in Central America, Parry says; Raymond’s team would spread rumors that they were secretly having sexual liaisons with Communist officials. Other reporters were dismissed as “liberals,” a label that many news executives were eager to avoid. Working through the news executives was remarkably successful, Parry says, and it was not long before many Washington reporters were either brought to heel or marginalized.
'Perception Management' - Reagan’s team called its domestic propaganda scheme “perception management.” Parry says: “The idea was that if you could manage how the American people perceived events abroad, you could not only insure their continued support of the foreign policy, but in making the people more compliant domestically. A frightened population is much easier to control. Thus, if you could manage the information flows inside the government and inside the Washington press corps, you could be more confident that there would be no more Vietnam-style protests. No more Pentagon Papers. No more My Lai massacre disclosures. No more Watergates.” The New York Times and Washington Post, the newspapers that had led the surge of investigative reporting in the 1970s, were effectively muzzled during the Reagan era; Parry says that the two papers “became more solicitous to the Establishment than they were committed to the quality journalism that had contributed to the upheavals of the 1960s and 1970s.” The same happened at the Associated Press (AP), where Parry had attempted, with limited success, to dig into the Reagan administration’s Central American policies, policies that would eventually crystallize into the Iran-Contra scandal (see May 5, 1987). Few newspapers followed the lead of AP reporters such as Parry and Brian Barger until late 1986, when the Hasenfus air crash provided a news story that editors could no longer ignore (see October 5, 1986). But, Parry says, by the time of the Iran-Contra hearings, few news providers, including the Associated Press, had the stomach for another scandal that might result in another impeachment, particularly in light of the relentless pressure coming from the Reagan administration and its proxies. By June 1990, Parry says he understood “the concept of ‘perception management’ had carried the day in Washington, with remarkably little resistance from the Washington press corps.… Washington journalists had reverted to their pre-Vietnam, pre-Watergate inability to penetrate important government secrets in a significant way.” The process accelerated after 9/11, Parry says: “[M]any journalists reverted back their earlier roles as stenographers to power. They also became cheerleaders for a misguided war in Iraq. Indeed, you can track the arc of modern American journalism from its apex at the Pentagon Papers and Watergate curving downward to that center point of Iran-Contra before reaching the nadir of Bush’s war in Iraq. Journalists found it hard even to challenge Bush when he was telling obvious lies. For instance, in June 2003, as the search for WMD came up empty, Bush began to tell reporters that he had no choice but to invade because Saddam Hussein had refused to let UN inspectors in. Though everyone knew that Hussein had let the inspectors in and that it was Bush who had forced them to leave in March 2003, not a single reporter confronted Bush on this lie, which he repeated again and again right through his exit interviews in 2008” (see November 2002-March 2003, November 25, 2002, December 2, 2002, December 5, 2002, January 9, 2003, March 7, 2003, and March 17, 2003).
The Wikileaks Era and the 'Fawning Corporate Media' - Parry says that now, the tough-minded independent media has been all but supplanted by what former CIA analyst Ray McGovern calls the “Fawning Corporate Media.” This has increased public distrust of the media, which has led to people seeking alternative investigative and reporting methods. Parry comments that much of the real investigative journalism happening now is the product of non-professionals working outside the traditional media structure, such as Wikileaks (see February 15, 2007, 2008, and April 18, 2009). However, the independent media have not demonstrated they can reach the level of influence of institutions like the Washington Post and the New York Times. “[I]f we were assessing how well the post-Watergate CIA-style covert operation worked,” Parry says, “we’d have to conclude that it was remarkably successful. Even after George W. Bush took the United States to war in Iraq under false pretenses and even after he authorized the torture of detainees in the ‘war on terror,’ no one involved in those decisions has faced any accountability at all. When high-flying Wall Street bankers brought the world’s economy to its knees with risky gambles in 2008, Western governments used trillions of dollars in public moneys to bail the bankers out. But not one senior banker faced prosecution.… Another measure of how the post-Watergate counteroffensive succeeded would be to note how very well America’s oligarchy had done financially in the past few decades. Not only has political power been concentrated in their hands, but the country’s wealth, too.… So, a sad but—I think—fair conclusion would be that at least for the time being, perception management has won out over truth. According to a poll just released by Dartmouth professor Benjamin Valentino, 63 percent of self-identified Republicans still believe that Iraq under Saddam Hussein possessed weapons of mass destruction when the US invaded in March 2003 (see March 19, 2003). Twenty-seven percent of self-identified independents and 15 percent of self-identified Democrats hold that view. Critics accuse an unnamed advisor to the Romney campaign of making a racially insensitive remark to British reporters when the advisor accused President Obama of not understanding the shared “Anglo-Saxon” heritage of the US and the United Kingdom (see July 24-25, 2012). Vice President, Obama Campaign Advisor Respond - Vice President Joseph Biden is quick to lambast the Romney campaign for the comment. “Despite his promises that politics stops at the water’s edge, Governor Romney’s wheels hadn’t even touched down in London before his advisors were reportedly playing politics with international diplomacy,” he says in a statement, “attempting to create daylight between the United States and the United Kingdom where none exists. Our special relationship with the British is stronger than ever and we are proud to work hand-in-hand with Prime Minister Cameron to confront every major national security challenge we face today. On every major issue—from Afghanistan to missile defense, from the fight against international terrorism to our success in isolating countries like Iran whose nuclear programs threaten peace and stability—we’ve never been more in sync. The comments reported this morning are a disturbing start to a trip designed to demonstrate Governor Romney’s readiness to represent the United States on the world’s stage. Not surprisingly, this is just another feeble attempt by the Romney campaign to score political points at the expense of this critical partnership. British Historian Questions Perception of 'Divisions' between Two Nations - British historian Tim Stanley says the perception of “divisions” between the US and the UK is overblown, and that many British citizens “love [Obama] because they see him as an antidote to the misdirected machismo of the Bush years. Few of us are keen to revive an alliance that led to the bloody mess of Iraq and Afghanistan.” More directly, the advisor’s “Anglo-Saxon” reference is obsolete and easily interpreted as racist. “Both countries are more multicultural than ever before, and both have forged alliances with countries that are decidedly un-Anglo-Saxon: the US is part of a trading bloc with Mexico and the UK is trapped in the engine room of the [European Union] Titanic,” Stanley writes. “Many will therefore interpret the choice of words as a clumsy attempt to play the race card, exploiting the impression that Obama is anti-British because he is of African descent.” Stanley writes that the advisors seemed more interested in painting Obama as a “left-winger” who lacks an understanding of the relations between the two nations than trying to make a racially insensitive remark, but he predicts the media will fasten onto the remark and label the Romney campaign, and perhaps Romney himself, as being racist to some degree. British Columnist: Romney Should Not 'Cast Us All Back into the Dark Ages' - Ian Vince, a columnist with The Guardian, asks what exactly the Romney campaign might mean by stating a desire to restore “Anglo-Saxon” relations between the two nations. Vince notes the thousand years of culture and heritage contributed by the Normans, the Romans, the Danish Jutes, and the Vikings, among others, and the huge number of non-“Anglo-Saxons” who consider themselves proud British citizens. He concludes by observing, “Mitt Romney would be wise not to cast us all back into the Dark Ages.” (Vince 7/25/2012)
Liberal News Site: Comments Part of Larger Attack on Obama's Heritage, Patriotism - Judd Legum of the liberal news Web site Think Progress says the comments are part of a much broader series of attacks on Obama’s heritage and patriotism by the Romney campaign. Legum calls the comments “the latest attack by the Romney campaign on Obama’s multi-cultural heritage.” Last week, Legum reminds readers, Romney campaign co-chair John Sununu told reporters Obama has no understanding of the “American system” because he “spent his early years in Hawaii smoking something, spent the next set of years in Indonesia,” and said Obama needs to “learn how to be an American.” Later that day, Romney himself called Obama’s policies “extraordinarily foreign.” (Legum 7/25/2012)
Neoconservative Magazine: Story Not Believable, Romney's Denial Should Settle Question - However, Alana Goodman of the neoconservative Commentary magazine says she did not believe the story from the moment it was reported. She says the story hinges entirely on a single unnamed source (the Romney advisor, who spoke on condition of anonymity), and accuses the Obama campaign of “scrambling to pump air into” the controversy surrounding the comments. She concludes, “Unless a reporter is able to verify who said this and what his role is in the campaign, Romney’s denial should put this story to rest.” (Goodman 7/25/2012)
