David Kay tells the Senate Armed Services Committee that the Iraq Survey Group has failed to find any evidence that Iraq possessed weapons of mass destruction. “Let me begin by saying, we were almost all wrong,” he says in his opening remarks, before revealing that the inspection teams found no weapons of mass destruction. “I believe that the effort that has been directed to this point has been sufficiently intense that it is highly unlikely that there were large stockpiles of deployed militarized chemical and biological weapons there,” he says. Hussein Deceived Own Generals - Kay says that apparently even Iraq’s own military commanders believed, falsely, that their military possessed chemical or biological weapons that were ready to be deployed. Senator Jeff Sessions (R-AL) asks Kay: “I believe at one point you noted that even [Saddam Hussein’s] own military officers believed that they had [WMD]. In other words, they would think—” Kay interjects, ”—that someone else had them.” Sessions asks for an explanation, and Kay says: “Well, in interviewing the Republican Guard generals and Special Republican Guard generals and asking about their capabilities and having them, the assurance was they didn’t personally have them and hadn’t seen them, but the units on their right or left had them. Trying to Have It Both Ways - In 2007, current CIA official Valerie Plame Wilson (see April 2001 and After) will write, “In retrospect, it appears that Saddam Hussein wanted it both ways: to convince certain audiences that Iraq had WMD, while simultaneously working to convince others that it had abandoned all its illegal programs.” In May 2006, Foreign Affairs magazine will note that Iraq’s former Defense Minister, Ali Hassan Majeed (also known as “Chemical Ali”), knew Iraq possessed no WMDs before the US invasion, but also knew that many of his colleagues “never stopped believing that the weapons still existed. Even at the highest echelon of the regime, when it came to WMD there was always some element of doubt about the truth.” The Foreign Affairs article notes that during a meeting of the Revolutionary Command Council some time before the invasion, Hussein was asked if Iraq indeed possessed such weapons. He said Iraq did not, but refused to countenance any attempt to persuade others outside of the council of the truth. The reason for this deception, Hussein said, was that if Israel believed Iraq had such weapons, it would be less likely to attack Iraq. [Wilson, 2007, pp. 154-155] Kay has just resigned as the head of the Iraq Survey Group (see January 23, 2004).

David Kay, former head of the Iraq Survey Group, meets with President Bush, Dick Cheney, Condoleezza Rice, and Andrew Card. The day before (see January 28, 2004), Kay had told Congress, “We were almost all wrong” about intelligence on Iraq’s presumed arsenal of illegal weapons. Bush wants to know what went wrong, but shows no anger. “The president accepted it,” Kay later recalls. “There was no sign of disappointment from Bush. He was at peace with his decision to go to war. After weapons inspector David Kay’s resignation (see January 23, 2004), the call to investigate the failure of intelligence surrounding the Iraq invasion reaches a fever pitch. White House press secretary Scott McClellan will later write: “[President] Bush and his advisers feared outside investigators. However, as momentum built for yet another independent probe, we saw the benefit of acting quickly and on our terms. Bush soon announced the creation of a bipartisan, independent commission to look into our intelligence on WMD, including Iraq (see March 8, 2005). Its members were appointed by the president, and its scope set by his team. It would not include looking at how the intelligence had been used to make the case for war. That was something Bush and his top advisers sought to avoid, concerned at a minimum—particularly in an election year—that it would prove politically fatal. They were willing to allow things to become more politicized, some considering it a battle that could be fought to a draw or even used to motivate the base, and believed that the short-term political cost could be minimized. In Bush’s mind, how the case for had been made scarcely mattered. What mattered now was the policy and showing success. The public tends to be more forgiving when the results are promising. If the policy was right and the selling of the policy could be justified at the time, then any difference between the two mattered little. In this view, governing successfully in Washington is about winning public opinion and getting positive results. To this day, the president seems unbothered by the disconnect between the chief rationale for war and the driving motivation behind it, and unconcerned about how the case was packaged.” [McClellan, 2008, pp. 202]

Former Vice President Al Gore gives a keynote address to a conference at the New School of New York City on the topic, “The Politics of Fear.” [Social Research: An International Quarterly of the Social Sciences, 2/2004] In his address, Gore notes the success that the Bush administration has had in preying on the fears of the American public. “Fear was activated on September 11 in all of us to a greater or lesser degree,” he says. “And because it was difficult to modulate or to change in particular specifics, it was exploitable for a variety of purposes unrelated to the initial cause of the fear. When the president of the United States stood before the people of this nation—in the same speech in which he used the forged document (see Mid-January 2003 and 9:01 pm January 28, 2003)—he asked the nation to ‘imagine’ how fearful it would feel if Saddam Hussein gave a nuclear weapon to terrorists who then exploded it in our country. Because the nation had been subjected to the fearful, tragic, cruel attack of 9/11, when our president asked us to imagine with him a new fear, it was easy enough to bypass the reasoning process, and short-circuit the normal discourse that takes place in a healthy democracy with a give-and-take among people who could say, ‘Wait a minute, Mr. President. Where’s your evidence? There is no connection between Osama bin Laden and Saddam Hussein.’ At one point, President Bush actually said, ‘You can’t distinguish between Saddam Hussein and Osama bin Laden’ (see September 25, 2002). He actually said that.” Gore says that for a time even he had trusted Bush to do the right thing, but Bush had abused the trust he and the American people had in him. In 2006, author and former White House counsel John Dean will write in conjunction with Gore’s address: “In short, fear takes reasoning out of the decision-making process, which our history has shown us often enough can have dangerous and long-lasting consequences. President Bush gives a rare interview to a television show, NBC’s Meet the Press. Bush holds the interview, conducted by Tim Russert, in the Oval Office. [CNN, 2/9/2004]
Admits Iraq Had No WMD - Bush concedes that Iraq did not possess weapons of mass destruction, but defends his decision to invade it, saying, “Saddam Hussein was dangerous, and I’m not just going to leave him in power and trust a madman.” He admits, “I expected to find the weapons.” He continues, “I’m sitting behind this desk, making a very difficult decision of war and peace, and I based my decision on the best intelligence possible, intelligence that had been gathered over the years, intelligence that not only our analysts thought was valid but analysts from other countries thought were valid.” And Iraq “had the ability to make weapons at the very minimum.” But even without proof of Iraqi WMD, Bush says the stakes were so high that “it is essential that when we see a threat, we deal with those threats before they become imminent.” Inaction in Iraq “would have emboldened Saddam Hussein. He could have developed a nuclear weapon over time.” Bush seems surprised when Russert asks if American soldiers had in fact been welcomed as “liberators” in Iraq, as some in his administration had predicted. “I think we are welcomed in Iraq,” he says. “I’m not exactly sure, given the tone of your questions, we’re not.” Resistance there is not surprising, Bush says, because “there are people who desperately want to stop the advance of freedom and democracy.” [NBC News, 2/8/2004; McClellan, 2008, pp. 202-203]
'War of Choice or War of Necessity?' - Russert continues to ask about the choice to invade Iraq, and at one point asks Bush whether it was a “war of choice or a war of necessity?” Bush responds: “That’s an interesting question. Please elaborate on that a little bit. A war of choice or a war of necessity? It’s a war of necessity. In my judgment, we had no choice, when we look at the intelligence I looked at, that says the man was a threat.” In 2008, current White House press secretary Scott McClellan will write that Bush asks him about the question after the interview, and that Bush was “puzzled” by the question. “This, too, puzzled me,” McClellan will write. “Surely this distinction between a necessary, unavoidable war and a war that the United States could have avoided but chose to wage, was an obvious one that Bush must have thought about a lot in the months before the invasion. Evidently it wasn’t obvious to the president, nor did his national security team make sure it was. He set the policy early on and then his team focused his attention on how to sell it. It strikes me today as an indication of his lack of inquisitiveness and his detrimental resistance to reflection, something his advisers needed to compensate for better than they did. Most objective observers today would say that in 2003 there was no urgent need to address the threat posed by Saddam with a large-scale invasion, and therefore the war was not necessary. Bush Says Congress Saw Same Intelligence He Did - Asked whether Congress would have authorized the invasion (see October 10, 2002) if he had explained that, while Iraq may not have possessed WMD, Hussein should be removed because he was a threat to his people, Bush replies, “I went to Congress with the same intelligence Congress saw—the same intelligence I had, and they looked at exactly what I looked at, and they made an informed judgment based upon the information that I had.” Two of Bush’s presidential rivals dispute Bush’s assertion. Senator John Edwards (D-NC) says Bush’s statement that Congress saw the same intelligence information as he did is a “big leap.” Edwards adds: “I’m not certain that’s true. I know the president of the United States receives a different set of information than we receive on the Senate Intelligence Committee, and he receives more information, which he should.” And front-runner Senator John Kerry (D-MA) accuses Bush of backpedaling on the messages he gave Americans to justify going to war. “George Bush needs to take responsibility for his actions and set the record straight,” he says. “That’s the very least that Americans should be able to expect. Either he believed Saddam Hussein had chemical weapons, or he didn’t. Confident of Winning Re-Election - Bush tells Russert that he is confident he will win re-election: “I don’t intend to lose.… I know exactly where I want to lead the country. Defends Economic Policies - Bush defends his economic policies, and says that even though under his watch the US has run up a $521 billion deficit and lost 2.2 million jobs, his administration’s policies are more restrained and fiscally sound than those of his predecessor. “I have been the president during a time of tremendous stress on our economy and made the decisions necessary to lead that would enhance recovery,” he says. “The stock market started to decline in March of 2000. That was the first sign that things were troubled. The recession started upon my arrival.” Conservative critics of his administration’s spending, including the Heritage Foundation and radio talk show host Rush Limbaugh, are “wrong,” he says. “If you look at the appropriations bills that were passed under my watch, in the last year of President Clinton, discretionary spending was up 15 percent, and ours have steadily declined. Defense Secretary Donald Rumsfeld says he cannot remember anyone making the claim that Iraq could launch weapons of mass destruction within 45 minutes. British Prime Minister Tony Blair made the claim over six months before the US-British invasion of Iraq (see September 24, 2002). The claim was later revealed to have come from a single, anonymous, unverified source (see August 16, 2003 and December 7, 2003). Some British newspapers ran banner headlines saying that the claim meant British troops in Cyprus could be attacked with Iraqi WMD within 45 minutes. The CIA sends a memo to top Bush administration officials informing them that Ibn al-Shaykh al-Libi, an al-Qaeda operative being held in custody by the CIA, recanted his claim in January that Iraq provided training in poisons and gases to members of al-Qaeda (see September 2002). Rove finds an e-mail message from himself to Deputy National Security Adviser Stephen Hadley recounting the conversation between himself and Cooper (see After 11:07 a.m. July 11, 2003). March 5, 2004: Libby Lies to Grand Jury

Lewis “Scooter” Libby, the former chief of staff for Vice President Dick Cheney, testifies under oath before the grand jury investigating the leak of CIA agent Valerie Plame Wilson’s identity (see December 30, 2003 and January 2004). According to the indictment that will later be issued against Libby (see October 28, 2005), he commits perjury during his testimony. [US Department of Justice, 3/5/2004 pdf file; MSNBC, 2/21/2007; Washington Post, 7/3/2007] Libby is questioned by special prosecutor Patrick Fitzgerald, who is aided by deputy special counsels Ron Roos, Peter Zeidenberg, and Kathleen Kedian. At the beginning of the questioning, Fitzgerald ensures that Libby understands the circumstances that constitute perjury.
Denies Being Source for Columnist - Fitzgerald asks Libby about his involvement as a source for columnist Robert Novak, who revealed Plame Wilson’s secret CIA status in a column (see July 14, 2003). Libby denies being a source for Novak.
Admits Learning about Plame Wilson's CIA Status from Cheney - He admits that Cheney told him that Joseph Wilson’s wife was a CIA officer: while discussing Wilson’s trip to Niger (see February 21, 2002-March 4, 2002), Libby says of Cheney: “And in the course of describing this he also said to me in sort of an off-hand manner, as a curiosity, that his wife worked at the CIA, the person who—whoever this person was. There were no names at that stage so I didn’t know Ambassador Wilson’s name at that point, or the wife’s name.” Libby also admits that he knew Plame Wilson worked at the “functional office” of the CIA that handled the Iraq WMD issue.
Libby 'Forgot' He Already Knew about Plame Wilson - Later in the interview, Fitzgerald asks again if it is “fair to say that [Cheney] had told you back in June, June 12 or before… that his wife worked in the functional office of counterproliferation of the CIA (see (June 12, 2003)). Correct?” Libby answers, “Yes, sir.” Fitzgerald then asks: “So when you say, that after we learned that his wife worked at the agency, that became a question. Isn’t it fair to say that you already knew it from June 12 or earlier?” Libby then answers: “I believe by, by this week I no longer remembered that. I had forgotten it. And I believe that because when it was told to me on July 10, a few days after this article, it seemed to me as if I was learning it for the first time. When I heard it, I did not think I knew it when I heard.” Libby is referring to his claim that he originally learned of Plame Wilson’s identity from NBC reporter Tim Russert (see July 10 or 11, 2003), a claim that Russert will strongly deny (see February 7-8, 2007). Claims Not to Have Discussed Plame Wilson until after Novak's Column Published - Fitzgerald asks Libby if he recalls the question of whether the possibility that Plame Wilson sent her “husband on a junket” (see July 7, 2003 or Shortly After), and whether he discussed it with Cheney. Libby replies: “I don’t recall the conversation until after the Novak piece. I don’t recall it during the week of July 6. I recall it after the Novak… after the Novak article appeared.” Fitzgerald, obviously unconvinced by Libby’s claim, asks, “And are you telling us under oath that from July 6 to July 14 you never discussed with Vice President Cheney whether Mr. Wilson’s wife worked at the CIA?” Libby responds: “No, no, I’m not saying that. On July 10 or 11 I learned, I thought anew, that the wife—that the reporters were telling us that the wife worked at the CIA. And I may have had a conversation with the vice president either late on the 11th or on the 12th in which I relayed that reporters were saying that.” Libby is lying by claiming he never discussed Plame Wilson with Cheney or other White House officials between July 6 and July 14 (see July 7, 2003 or Shortly After, July 7-8, 2003, July 8, 2003, 12:00 p.m. July 7, 2003, and July 10 or 11, 2003). Denies Learning of State Department Memo until Late September 2003 - Libby also denies learning of the State Department’s interest in the Wilson trip and in Wilson’s wife until after the investigation into Plame Wilson’s identity became public on September 28, 2003, “a couple days after that,” he says. “I don’t have any recollection of an INR [Bureau of Intelligence and Research, the State Department’s intelligence bureau] document prior to that date.” Libby is lying; he learned about the State Department’s inquiry into the Wilson trip, and Plame Wilson’s CIA status, much earlier (see 12:00 p.m. June 11, 2003). He also denies asking the State Department’s Marc Grossman for information on Wilson’s Niger trip, which is most likely another lie (see May 29, 2003). And he claims not to remember if he learned from Grossman that Plame Wilson was a CIA official.
Denies Talking to CIA Official - Libby also claims not to remember discussing Plame Wilson with Robert Grenier, the CIA’s Iraq mission manager. “I don’t think I discussed Wilson’s wife’s employment with, with Mr. Grenier,” he testifies. “I think if I discussed something it was what they knew about the request about Mr., about Mr. Wilson. I don’t recall the content of the discussion.” Asked “if there was an urgency to the conversation” with Grenier, Libby replies, “I recall that I was reaching Mr. Grenier—I was trying to reach Mr. McLaughlin [John McLaughlin, then the CIA’s deputy director, who spoke to Cheney the day before about Plame Wilson—see 12:00 p.m. June 11, 2003) and couldn’t, and spoke instead to Mr. Grenier. And so if I did that instead of just waiting for Mr. McLaughlin, it was probably something that was urgent in the sense that my boss, the vice president, wanted, wanted to find something out. Not, not necessarily in the real world, but he wanted an answer and usually we try and get him the answer when we can.” Libby did indeed meet with Grenier, and quizzed him about Plame Wilson (see 2:00 p.m. June 11, 2003).
Denies Leaking Name to Post Reporter - Libby claims not to be sure if he was a source for a June 2003 article by Washington Post reporter Walter Pincus (see June 12, 2003), but says he is sure he did not divulge Plame Wilson’s identity to him. “I have no recollection of having discussed it with Mr. Pincus and I don’t think I did,” Libby testifies. He acknowledges that his own notes, entered into evidence by Fitzgerald, show that he discussed the Pincus article with Cheney before it was published. Libby also denies revealing Plame Wilson’s identity to two New York Times reporters, David Sanger and James Risen.
Challenges Wilson's Characterization of Iraq-Niger Claims - Using language similar to that he and other members of Cheney’s staff have used in press conferences and to individual reporters, Libby says that Joseph Wilson’s questioning of the Iraq-Niger claims were ill-informed, and that Wilson was wrong to speculate that Cheney had deliberately ignored the evidence that those claims were false to insist that Iraq had an active nuclear weapons program and therefore constituted a danger to the US (see March 24, 2002, August 2002, March 16, 2003, and July 6-10, 2003). Libby says of Wilson’s op-ed in the New York Times (see July 6, 2003), “It’s a, it’s a bad article.” He admits to being angry over the article, then changes it to being “concerned because it didn’t seem to me an accurate portrayal of the facts.… Upset’s a fair word, I guess.” He admits to discussing the Wilson op-ed with Cheney shortly after its publication, though he is unsure of the exact date of that discussion (see July 6-10, 2003, July 7-8, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Richard Clarke, counterterrorism “tsar” from 1998 until October 2001, ignites a public debate by accusing President Bush of doing a poor job fighting al-Qaeda before 9/11. In a prominent 60 Minutes interview, he says: “I find it outrageous that the president is running for re-election on the grounds that he’s done such great things about terrorism. He ignored it. He ignored terrorism for months, when maybe we could have done something to stop 9/11.… I think he’s done a terrible job on the war against terrorism.” He adds: “We had a terrorist organization that was going after us! Al-Qaeda. That should have been the first item on the agenda. And it was pushed back and back and back for months.” He complains that he was Bush’s chief adviser on terrorism, yet he never got to brief Bush on the subject until after 9/11. [CBS News, 3/21/2004; CBS News, 3/21/2004; Guardian, 3/23/2004; Salon, 3/24/2004] Author Philip Shenon will call the interview “gripping” and comment that Clarke is “made for television.” This is because of his “urgent speaking style” and his “shock of white hair and ghostly pallor,” which makes it look like he has “emerged from years of hiding in sunless back rooms of the West Wing to share the terrible secrets he ha[s] learned.” [Shenon, 2008, pp. 277] The next day, his book Against All Enemies is released and becomes a bestseller. As is the tradition of the dinner, powerful lawmakers and media figures poke fun at themselves and the issues of the day, usually with little political fallout. But many are offended by Bush’s humor in the slide show. One picture shows Bush looking under a piece of furniture in the Oval Office, with his accompanying remark, “Those weapons of mass destruction have got to be here somewhere.” A second slide shows him looking in the corner of a room, and the voiceover says, “No, no weapons over there.” A third picture has him leaning over and saying, “Maybe under here?” While most participants at the dinner laugh appreciatively, many others are offended, seeing Bush as making light of the rationale for a war that has led to the death of almost 600 American soldiers by this time. Richard Clarke sworn in before the 9/11 Commission.Richard Clarke sworn in before the 9/11 Commission. [Source: CBC]Former counterterrorism “tsar” Richard Clarke testifies before the 9/11 Commission. Due to publicity generated by the publication of his book and a controversial appearance on 60 Minutes (see March 21, 2004), it is, in the words of author Philip Shenon, a “true Washington spectacle” and “one of those moments in the capital when anyone of importance in the city [is] in front of a television set.” Shenon will add, “It was being compared by reporters to the sort of drama that John Dean’s testimony provided in Watergate or Lieutenant Colonel Oliver North’s testimony offered in the Iran-Contra affair.” [Shenon, 2008, pp. 281-282]
Clarke Offers Apology - Clarke’s opening statement consists of little more than an apology to the relatives of the 9/11 victims. He says: “Your government failed you, those entrusted with protecting you failed you, and I failed you. For that failure, I would ask… for your understanding and forgiveness.” This leads to a moment of silence, then gasps and sobs. Shenon will point out, “It was the first apology that the 9/11 families had heard from anybody of importance in the Bush administration,” adding that it “was the moment of catharsis that many of the wives and husbands and children of the victims had been waiting for.”
Praises Clinton, Criticizes Bush - Under questioning, Clarke praises the Clinton administration, saying, “My impression was that fighting terrorism, in general, and fighting al-Qaeda, in particular, were an extraordinarily high priority in the Clinton administration—certainly no higher priority.” But he is very critical of the Bush administration, stating, “By invading Iraq… the president of the United States has greatly undermined the war on terrorism.” He says that under Bush before 9/11, terrorism was “an important issue, but not an urgent issue.… [CIA Director] George Tenet and I tried very hard to create a sense of urgency by seeing to it that intelligence reports on the al-Qaeda threat were frequently given to the president and other high-level officials. But although I continue to say it was an urgent problem, I don’t think it was ever treated that way.” He points out that he made proposals to fight al-Qaeda in late January 2001. While the gist of them was implemented after 9/11, he complains, “I didn’t really understand why they couldn’t have been done in February [2001].” He says that with a more robust intelligence and covert action program, “we might have been able to nip [the plot] in the bud.”
Republican Commissioners Ask Tough Questions - However, Clarke faces tough questioning from some of the Republican commissioners. Jim Thompson, who had been in contact with the White House before the hearing (see Morning, March 24, 2004), challenges Clarke over a briefing he gave in 2002 (see August 22, 2002 and March 24, 2004), which, according to Thompson, contradicts what Clarke is saying now. In addition, fellow Republican John Lehman confronts Clarke over what he sees as discrepancies between Clarke’s book and his private interviews with the Commission. Clarke replies that the differences arose because the Commission did not ask him about all the issues he covered in his book, such as his opposition to the invasion of Iraq. He adds that he will not accept any position in any administration formed by Democratic presidential candidate John Kerry.
Clarke Approved Saudi Flights - Clarke also clears up a mystery about the departure of Saudi Arabian nationals after the attacks, which has caused some controversy (see September 14-19, 2001), saying that he was the White House official that approved them. He did this after clearing it with the FBI, although he does not know “what degree of review the FBI did over those names.” [Washington Post, 3/24/2004; New York Times, 3/24/2004; 9/11 Commission, 3/24/2004; Shenon, 2008, pp. 282-289]
Testimony 'Arresting' - Author and media critic Frank Rich will later call Clarke’s testimony “arresting.” Rich will write that Clarke’s forceful, confident demeanor—“sonorous voice, secret-agent aura, and vaguely intimidating body language”—serves to brush back antagonistic Republicans such as Lehman and Thompson. Rich will write that the juxtaposition of Clarke’s damning testimony with President Bush’s bizarre comedy routine that same evening (pretending to hunt for Iraqi WMD under the Oval Office furniture—see March 24, 2004) is jarring. At a campaign appearance in New Hampshire, President Bush refers to the 9/11 attacks, saying, “Had I known that the enemy was going to use airplanes to strike America, to attack us, I would have used every resource, every asset, every power of this government to protect the American people.” He also suggests that his predecessor, Democrat Bill Clinton, was more to blame for the attacks than he was, as the 9/11 Commission is looking at “eight months of my administration and the eight years of the previous administration.” This speech comes one day after his former counterterrorism “tsar,” Richard Clarke, had given damaging high-profile testimony to the Commission (see March 24, 2004). Author Philip Shenon will comment that Bush “was apparently hoping that his audience would forget that the August 6 [Presidential Daily Brief item (see August 6, 2001)] had warned specifically that planes might be hijacked by al-Qaeda within the United States.” [Shenon, 2008, pp. 289]

The Bush administration bows to growing pressure in the wake of former counterterrorism “tsar” Richard Clarke’s testimony before the 9/11 Commission (see March 21, 2004) and agrees to allow National Security Adviser Condoleezza Rice to testify before the Commission in public and under oath. It also agrees that President Bush and Vice President Dick Cheney can be interviewed in private by the whole Commission. However, according to the New York Times, “In exchange for her appearance, the [9/11 Commission] agreed not to seek testimony from other White House aides at public hearings, although it can continue to question them in private.” [New York Times, 3/31/2004] There was some debate in the administration over whether Rice would testify or not. As she is national security adviser and there are no allegations of criminal wrongdoing, there are good grounds for Rice refusing to testify under the doctrine of executive privilege, and this argument is made in particular by White House counsel Alberto Gonzales and David Addington, Vice President Cheney’s counsel. However, Rice insists that she wants to testify. According to author Philip Shenon, she is “uncharacteristically frantic” over the issue. White House chief of staff Andy Card will say, “Condi desperately wanted to do it.” Shenon will write of the decision, which is made by President Bush: “The political pressure on the White House was too great, and Rice’s persuasive powers with the president were more than a match for Alberto Gonzales’s. Rice was as strong-willed as any member of the White house staff. Gonzales was strong-willed until the president told him otherwise.” [Shenon, 2008, pp. 289-292] Author and media critic Frank Rich will later write: “The dirty little secret about the uproar over Clarke’s revelations were that many of them had been previously revealed by others, well before he published his book. But as the Bush administration knew better than anyone, perception was all, and perception began with images on television. Clarke had given the charges a human face.” The administration is sending Rice to testify publicly before the Commission, Rich will write, in part because she is the most telegenic of Bush’s top advisers, and has the best chance of “rebranding” the story with her face and testimony. Cover of Wilson’s ‘The Politics of Truth.’Cover of Wilson’s ‘The Politics of Truth.’ [Source: Barnes and Noble]Former ambassador Joseph Wilson, who helped disprove the White House’s claim that Iraq had attempted to buy uranium from Niger (see February 21, 2002-March 4, 2002 and July 6, 2003) and in turn had his wife, Valerie Plame Wilson, exposed as a CIA agent through a White House leak (see July 14, 2003, September 26, 2003, and September 30, 2003), publishes his book, The Politics of Truth: Inside the Lies that Led to War and Betrayed My Wife’s CIA Identity: A Diplomat’s Memoir. He had signed with a relatively small publisher, Carroll & Graf, after making a gentleman’s agreement with C&G editor Philip Turner, and refused to allow his literary agent to bid his book out for a larger advance in order to honor the agreement with Turner. According to Wilson’s wife, he worked relentlessly for four months to complete the book, eager to tell not just the story of his trip to Niger and his wife’s outing, but to write about his wide and varied diplomatic career in Africa and the Middle East (see September 5, 1988 and After, September 20, 1990, and Late November, 1990). [Wilson, 2007, pp. 171-172] The book sells well and garners mostly positive reviews; for example, author and former White House counsel John Dean gives it a glowing review in the New York Times (see May 12, 2004). But right-wing supporters of the Bush administration quickly publish their own vilifications of Wilson and his book (see July 12, 2004). Plame Wilson will write in 2007: “Having lived through the first spate of attacks on Joe’s credibility and character in the wake of the leak, I thought I had acquired some armor. I was wrong. I knew the comments were politically motivated, but they were still painful to read, and once again we felt under siege.” Plame Wilson is particularly alarmed by the death threats made against her and her family by unidentified telephone callers, including one “seriously deranged person” who manages to talk to her four-year-old son for a moment. She asks the CIA for additional security measures to protect her children, a request that the agency will eventually deny. She will recall: “To say that the CIA response ‘disappointed’ me doesn’t begin to touch the betrayal that I felt. After [REDACTED] loyal service, I expected the agency to come through on its standing promise to protect its ‘family,’ something that had always been a point of CIA pride.… Clearly, I was on my own.” [Wilson, 2007, pp. 178-180]

Spc. Casey Sheehan.Spc. Casey Sheehan. [Source: Associated Press]Specialist Casey Sheehan, an Eagle Scout, church group leader, and honor student who enlisted in the Army in 2000, dies during an ambush in Sadr City, Baghdad. Sheehan had been in Iraq for only two weeks. His death will drive his mother, Cindy Sheehan, to become a noted peace activist (see August 6, 2005 and After). Specialist Sheehan and six other American soldiers die during a rescue mission in Sadr City. Sheehan and his compatriots are left to fend for themselves by their Iraqi cohorts, newly trained militiamen who flee when fighters for Moqtada al-Sadr’s Mahdi Army attack their position. Sheehan’s death will become a powerful counterargument against claims by Defense Secretary Donald Rumsfeld and other Bush officials that “over 200,000 Iraqis… have been trained and equipped” and are “out on the front line taking the brunt of the violence.” Author and media critic Frank Rich will write that given the wildly inflated claims by Rumsfeld and others about the size and effectiveness of the Iraqi soldiers, and the increasing power wielded by al-Sadr, “[i]t is hard to see what Cindy Sheehan’s young son had died for.” [US Department of Defense, 4/7/2004; Rich, 2006, pp. 193-194] Mrs. Sheehan, as part of a group of bereaved family members who suffered their own losses in Iraq, will meet with President Bush soon after her son’s death, and come away dissatisfied and angry. Recalling the meeting, she will say: “We wanted [the president] to look at pictures of Casey, we wanted him to hear stories about Casey, and he wouldn’t. He changed the subject every time we tried. He wouldn’t say Casey’s name, called him, ‘your loved one.’” [Los Angeles Times, 8/11/2005]

[Source: Larry Downing/ Reuters]National Security Adviser Condoleezza Rice testifies before the 9/11 Commission under oath and with the threat of perjury. The Bush administration originally opposed her appearance, but relented after great public demand (see March 30, 2004). [Independent, 4/3/2004] The testimony is a huge media event and major television networks interrupt their programming to carry it live. First, the Commission’s Democratic Vice Chairman Lee Hamilton reads a statement trying to establish a tone of non-confrontation and saying that the Commission’s purpose is “not to put any witness on the spot,” but “to understand and to inform.”
Rice Reads Lengthy Statement - Knowing that she has a deal to appear only once and for a limited time, Rice begins by reading a statement much longer than those read by other witnesses testifying before the Commission, a move specifically approved by Hamilton and the Commission’s chairman Tom Kean. [Shenon, 2008, pp. 293, 295] In the statement she repeats her claim that “almost all of the reports [before 9/11] focused on al-Qaeda activities outside the United States.… The information that was specific enough to be actionable referred to terrorists operation overseas.” Moreover, she stresses that the “kind of analysis about the use of airplanes as weapons actually was never briefed to us.” But she concedes: “In fact there were some reports done in ‘98 and ‘99. I think I was—I was certainly not aware of them.” [Washington Post, 4/8/2004]
Heated Questioning from Democrats - The exchanges with the Republican commissioners are polite, but Rice’s interactions with the Democrats on the Commission become heated. According to author Philip Shenon, her strategy is to “try to run out the clock—talk and talk and talk, giving them no chance to ask follow-up questions before the 10 minutes that each of the commissioners had been allotted had run out.” [Shenon, 2008, pp. 295] During questioning several subjects are discussed:
bullet Why didn’t counterterrorism “tsar” Richard Clarke brief President Bush on al-Qaeda before September 11? Clarke says he had wished to do so, but Rice states, “Clarke never asked me to brief the president on counterterrorism.”
bullet What was the content of the briefing President Bush received on August 6, 2001 (see August 6, 2001)? While Rice repeatedly underlines that it was “a historical memo… not threat reporting,” commissioners Richard Ben-Veniste and Tim Roemer ask her why it cannot therefore be declassified. [Washington Post, 4/8/2004] Asked what the PDB item’s still-secret title is, Rice gives it as “Bin Laden Determined to Attack inside the United States,” leading to an audible gasp from the audience. [Shenon, 2008, pp. 298] Two days later, the White House will finally publish it, and it will be shown to contain more than just historical information.
bullet Did Rice tell Bush of the existence of al-Qaeda cells in the US before August 6, 2001? Rice says that she does not remember whether she “discussed it with the president.”
bullet Were warnings properly passed on? Rice points out: “The FBI issued at least three nationwide warnings to federal, state, and law enforcement agencies, and specifically stated that although the vast majority of the information indicated overseas targets, attacks against the homeland could not be ruled out. The FBI tasked all 56 of its US field offices to increase surveillance of known suspected terrorists and to reach out to known informants who might have information on terrorist activities.” But commissioner Jamie Gorelick remarks: “We have no record of that. The Washington field office international terrorism people say they never heard about the threat, they never heard about the warnings.” [Washington Post, 4/8/2004]
bullet Under questioning from Democratic commissioner Bob Kerrey, she admits that she worked with Philip Zelikow, the Commission’s executive director, during the Bush administration transition, and that they discussed terrorism issues.
bullet She claims that a plan Clarke presented to her to roll back al-Qaeda in January 2001 (see January 25, 2001) was not actually a plan, but merely “a set of ideas and a paper” that had not been implemented. [Shenon, 2008, pp. 299-300]
Central Issues Unresolved - Rice does not apologize to the families of the victims of the 9/11 attacks, as Clarke did weeks earlier. The Associated Press comments, “The blizzard of words in Condoleezza Rice’s testimony Thursday did not resolve central points about what the government knew, should have known, did, and should have done before the September 11 terrorist attacks.” [Associated Press, 4/8/2004]
Testimony an 'Ambitious Feat of Jujitsu' - The Washington Post calls her testimony “an ambitious feat of jujitsu: On one hand, she made a case that ‘for more than 20 years, the terrorist threat gathered, and America’s response across several administrations of both parties was insufficient.’ At the same time, she argued that there was nothing in particular the Bush administration itself could have done differently that would have prevented the attacks of September 11, 2001—that there was no absence of vigor in the White House’s response to al-Qaeda during its first 233 days in office. The first thesis is undeniably true; the second both contradictory and implausible.” [Washington Post, 4/9/2004]
'Cherry-Picking' Rice's Testimony - In 2009, Lawrence Wilkerson, who is chief of staff for Secretary of State Colin Powell in 2004, will recall: “John [Bellinger, the legal adviser to the National Security Council] and I had to work on the 9/11 Commission testimony of Condi. Condi was not gonna do it, not gonna do it, not gonna do it, and then all of a sudden she realized she better do it. That was an appalling enterprise. We would cherry-pick things to make it look like the president had been actually concerned about al-Qaeda. We cherry-picked things to make it look as if the vice president and others, Secretary Rumsfeld and all, had been. They didn’t give a sh_t about al-Qaeda. They had priorities. The priorities were lower taxes, ballistic missiles, and the defense thereof.” [Vanity Fair, 2/2009]

President Bush talks about the Presidential Daily Briefing (PDB) he was given on August 6, 2001, entitled “Bin Laden Determined to Strike in US.” He claims, “There was nothing in this report to me that said, ‘Oh, by the way, we’ve got intelligence that says something is about to happen in America.‘… There was nothing in there that said, you know, ‘There is an imminent attack.’ That wasn’t what the report said. The report was kind of a history of Osama’s intentions.” [Associated Press, 4/12/2004] He adds, “[T]he PDB was no indication of a terrorist threat. There was not a time and place of an attack. It said Osama bin Laden had designs on America. Well, I knew that. What I wanted to know was, is there anything specifically going to take place in America that we needed to react to.… I was satisfied that some of the matters were being looked into. But that PDB said nothing about an attack on America. It talked about intentions, about somebody who hated America—well, we knew that.… Had I known there was going to be an attack on America, I would have moved mountains to stop the attack.” [US President, 4/19/2004] The complete text of the PDB was released the day before Bush’s comments and in fact the PDB does very clearly discuss an imminent attack on the US. For instance, it says that FBI information “indicates patterns of suspicious activity in this country consistent with preparations for hijackings or other types of attacks, including recent surveillance of federal buildings in New York.” And it discusses a call to a US “embassy in the UAE in May [2001] saying that a group of bin Laden supporters was in the US planning attacks with explosives” (see August 6, 2001).

In a news conference, President Bush is asked about the August 6, 2001 Presidential Daily Briefing (PDB) item entitled “Bin Laden Determined to Strike in US” (see August 6, 2001). Bush explains: “I asked for the briefing. And the reason I did is because there had been a lot of threat intelligence from overseas. And part of it had to do with the Genoa G8 conference that I was going to attend. And I asked at that point in time, let’s make sure we are paying attention here at home as well. And that’s what triggered the report.” [US President, 4/19/2004] Although Bush had shown some interest in counterterrorism around that time (see July 5, 2001 and June 20, 2001), the CIA analysts who drafted the PDB item will deny he asked for it specifically, saying they drafted it on the CIA’s initiative (see July 13, 2004). The main threat to the late July 2001 Genoa conference, as discussed in numerous articles even before the conference, was an al-Qaeda plot to fly an airplane into the conference building, killing Bush and other world leaders (see Mid-July 2001). But Bush’s tacit admission that a plot involving planes as weapons helped inspire the well-known August briefing passes without comment by the mainstream media. However, a professor will write a letter to the editor of Britain’s Financial Times noting Bush’s remark and commenting, “If President Bush had been sufficiently alarmed by the Italian defenses [against a suicide air attack] in Genoa to request a special report, he must have been able to recognize that, yes, it could happen in the US.” [Financial Times, 4/27/2004]

In a public interview with the 9/11 Commission, CIA Director George Tenet falsely claims that he had no communication with President Bush during August 2001, a period when the CIA was aware of increasing signs al-Qaeda would attack the US. Tenet actually met Bush at least twice during this period (see August 17 and 31, 2001). The claim is made in a question and answer session with Commissioner Tim Roemer, who asks Tenet about it because of its links to the mid-August arrest of Zacarias Moussaoui and Tenet’s knowledge of this (see August 17 and 31, 2001, August 23, 2001, and September 1-8, 2001).
"I Don't Believe I Do" - When Roemer asks Tenet “when do you see him [Bush] in August?” Tenet replies, “I don’t believe I do.” Roemer asks again and Tenet, who spent days reading documents to be ready for his discussions with the 9/11 Commission (see Before January 22, 2004), says: “He’s in Texas, and I’m either here or on leave for some of that time. So I’m not there.” When asked about whether he spoke to Bush on the phone in August, he says, “we talked to him directly through the spring and early summer almost every day,” but he himself did not speak to Bush in August.
Bombshell - Roemer thinks the admission CIA Director Tenet did not talk to the president for a month during a period of increased threat is a “bombshell,” and is aware that others on the commission believe that Tenet has repeatedly lied to them (see January 22, 2004 and July 2, 2004). However, as Tenet denies there were any such meetings or conversations and Roemer does not know otherwise yet, he cannot pursue the topic and moves on to the question.
Furious - However, Tenet’s statement is quickly discovered to be untrue, and later that day the CIA’s press office calls round Washington informing reporters that Tenet “momentarily forgot” about the two briefings. Roemer is then “furious” with Tenet. He had wanted to withhold judgment on Tenet despite the criticism from the Commission’s staff, but now decides that he can “assume the worst about Tenet’s veracity—and the worst about what had happened in August between him and the president.”
'Hotter than Hades - Roemer is especially skeptical of Tenet’s claim he does not recall that he flew to Texas in the middle of August: “It’s probably 110 degrees down there, hotter than Hades… You make one trip down there the whole month and you can’t remember what motivates you to go down there to talk to the president?” Roemer’s suspicion that Tenet and Bush talked about domestic terrorism will later be supported by a section in a 2007 book by Tenet, which says, “a few weeks after the Aug. 6 PDB [entitled “Bin laden Determined to Strike in US”] was delivered, I followed it to Crawford to make sure the president stayed current on events.” In the book, Tenet will recall not only flying to Texas, but also being driven around the ranch by Bush and discussing the plants and animals on it with him. [Washington Post, 4/15/2004; Shenon, 2008, pp. 361-362]

Testifying Together, without Oaths or Recordings - The Commission permits Bush and Cheney, accompanied by White House counsel Alberto Gonzales, to appear together, in private, and not under oath. Author Philip Shenon will comment that most of the commissioners think this is an “obvious effort… to ensure that the accounts of Bush and Cheney did not differ on the events of 9/11.” [Shenon, 2008, pp. 342-343] Their testimony is not recorded. Questions Similar to Those Asked of Clinton - The Commission draws its questions from a previously-assembled list of questions for Bush and Cheney that Commission members have agreed to ask. According to commissioner Bob Kerrey: “It’s essentially the same set of questions that we asked President Clinton with one exception, which is just what happened on the day of September 11th. What was your strategy before, what was your strategy on September 11, and what allowed the FAA to be so surprised by a hijacking?” [Washington Post, 4/29/2004]
'Three Hours of Softballs' - After Bush starts the meeting with an apology for an attack by Attorney General John Ashcroft on commissioner Jamie Gorelick (see April 13-April 29, 2004), the Democratic commissioners are disarmed. Commissioner Slade Gorton will comment: “They knew exactly how to do this. They had us in the Oval Office, and they really pulled the talons and the teeth out of many of the Democratic questions. Several of my colleagues were not nearly as tough in the White House as they were when we went in that day.” Author Philip Shenon will call it “three hours of softballs.” Some of the toughest questions are asked by Republican John Lehman, who focuses on money allegedly passed by an acquaintance of the Saudi ambassador’s wife to two of the hijackers (see December 4, 1999). Cheney Says Little - Although the Commission’s Democrats are expecting Bush to defer to the vice president in his responses, reportedly Bush “thoroughly dominate[s] the interview.” Philip Zelikow, the Commission’s executive director, will later recall that Cheney only “spoke five percent of the time.” [Draper, 2007, pp. 292] According to four unnamed individuals that are in the room during the meeting, Cheney “barely spoke at all.” [Gellman, 2008, pp. 344] Gorelick will say: “There was no puppeteering by the vice president. Former ambassador Joseph Wilson, discussing his two trips to Niger in 1999 (see Fall 1999) and 2002 (see February 21, 2002-March 4, 2002) to investigate whether Iraq was attempting to obtain uranium from that nation, says that in 1999 he never discussed the subject of uranium purchases. Wilson, who met with former Nigerien Prime Minister Ibrahim Mayaki, says: “At that meeting, uranium was not discussed. It would be a tragedy to think that we went to war over a conversation in which uranium was not discussed because the Niger official was sufficiently sophisticated to think that perhaps he might have wanted to discuss uranium at some later date.” He will later tell Senate Intelligence Committee staffers that Mayaki was leery of discussing any trade issues at all because Iraq was under United Nations sanctions. Vice President Dick Cheney is interviewed in his office by federal prosecutors as part of the Valerie Plame Wilson identity leak investigation (see December 30, 2003). Cheney is asked if he knows who, if anyone, in the White House might have leaked Plame Wilson’s identity to the press. He is asked about conversations with his senior aides, including his chief of staff, Lewis “Scooter” Libby. He is also asked whether he knows of any concerted effort by White House officials to leak Plame Wilson’s identity. Cheney is not questioned under oath, and has not been asked to testify before the grand jury. He is represented by two lawyers, Terrence O’Donnell and Emmet Flood. Cheney Evades, Refuses to Answer Questions - In October 2009, an FBI interview summary regarding Cheney’s testimony will be released (see October 1, 2009). According to the document, Cheney equivocates or refuses to answer 72 times during his interview, either saying he cannot be certain about the information requested, or that he does not know.
Denies Informing Libby about Plame Wilson's CIA Status - One of the most fundamental questions Cheney is asked is about how Libby learned about Plame Wilson’s identity. Libby’s own notes indicate that he learned it from Cheney, and that he had shared his notes with Cheney in late 2003 (see Late September or Early October, 2003), in defiance of instructions from the FBI and the White House counsel’s office not to share information with colleagues (see September 29-30, 2003). But in his testimony, Cheney “cannot recall Scooter Libby telling him how he first heard of Valerie Wilson. It is possible Libby may have learned about Valerie Wilson’s employment from the vice president… but the vice president has no specific recollection of such a conversation.” [Federal Bureau of Investigation, 5/8/2004 pdf file; Associated Press, 11/2/2009] Cheney testifies that contrary to the evidence, he learned of Plame Wilson’s CIA status from Libby, who informed him that a number of reporters had contacted Libby in July 2003 to say that Plame Wilson had been responsible for arranging her husband’s trip to Niger to investigate the Niger uranium claims. Cheney says that the next time he heard about Plame Wilson and her connection to her husband was when he read Robert Novak’s article outing her as a CIA officer (see July 14, 2003). Cheney is lying; he informed Libby of Plame Wilson’s identity (see (June 12, 2003)).
Denies Knowledge of Wilson Trip to Niger - He also denies knowing that Plame Wilson’s husband, war critic and former ambassador Joseph Wilson, was sent to Niger to investigate claims that Iraq was attempting to buy uranium from that country (see (February 13, 2002) and February 21, 2002-March 4, 2002), and says the CIA never briefed him about Wilson’s trip (see March 5, 2002). Future testimony will challenge Cheney’s claims, as witnesses will testify that Cheney, Libby, Deputy National Security Adviser Stephen Hadley, the Defense Department, the State Department, the Defense Intelligence Agency, the Joint Chiefs of Staff, the National Security Council, and President Bush were all given copies of a CIA cable sent to Cheney’s office that debunked the Niger claims (see December 2001, Shortly after February 12, 2002, March 5, 2002, February 12, 2002, March 8, 2002, October 15, 2002, Mid-October 2002, October 18, 2002, January 2003, and March 8, 2003). Refuses to Answer about WMD NIE - Prosecutor Patrick Fitzgerald, leading the interview, presses Cheney to discuss evidence that shows he pressured Bush to quickly declassify portions of the October 2002 National Intelligence Estimate on Iraqi WMD (see October 1, 2002) for the purpose of making the case for invading Iraq. Libby provided selected NIE information to New York Times reporter Judith Miller while simultaneously leaking Plame Wilson’s identity to her (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003) and other reporters. Cheney refuses to confirm that he discussed anything regarding the NIE with Bush, saying that he could not comment on any private or privileged conversations he may have had with the president. Libby has already testified to the declassification of the NIE, telling prosecutors that he talked to Miller following the “president’s approval relayed to me through the vice president.”
Insists Plame Wilson's Identity Never Used to Discredit Husband - Cheney insists that no one in the White House ever talked about leaking Plame Wilson’s CIA status to the press in an attempt to discredit her husband. There was never any discussion, Cheney says, of “pushing back” on Wilson’s credibility by raising the issue of nepotism, the fact that his wife worked for the CIA, the same agency that dispatched him to Niger to run down the report of an agreement to supply uranium to Iraq. In his own testimony, Libby was far less emphatic, saying “[i]t’s possible” he may have discussed the idea with Cheney. Both men lie in their testimony (see March 9, 2003 and After, May 2003, June 3, 2003, June 9, 2003, June 11 or 12, 2003, (June 11, 2003), 12:00 p.m. June 11, 2003, 2:00 p.m. June 11, 2003, 5:27 p.m. June 11, 2003, (June 12, 2003), June 19 or 20, 2003, July 7, 2003 or Shortly After, July 7-8, 2003, 12:00 p.m. July 7, 2003, July 8, 2003, and 7:35 a.m. July 8, 2003). Author and former Nixon White House counsel John Dean reviews former ambassador Joseph Wilson’s new book, The Politics of Truth (see April 2004). Dean, who has long been a fierce critic of the Bush administration, uses the review to examine aspects of the controversy surrounding the White House’s disproven claim that Iraq attempted to buy uranium from Niger (see February 21, 2002-March 4, 2002 and July 6, 2003) and the outing of Wilson’s wife as a CIA agent through a White House leak (see June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, Before July 14, 2003, and July 14, 2003). Dean calls the book “riveting and all-engaging… provid[ing] context to yesterday’s headlines, and perhaps tomorrow’s, about the Iraq war and about our politics of personal destruction,” as well as detailed information about Wilson’s long diplomatic service in Africa and the Middle East, and what Dean calls “a behind-the-scenes blow-by-blow of the run-up to the 1991 Persian Gulf war.”
'Anti-Dumb-War' - Dean also admires Wilson’s opposition to the Iraq war, saying that “Wilson is not antiwar. Rather, he is ‘anti-dumb-war’” and noting that while Wilson is not himself particularly conservative (or liberal), he considers the neoconservatives who make up the driving force in President Bush’s war cabinet “right-wing nuts.”
'Vicious Hatchet Job' - Dean quickly moves into the White House-orchestrated attempt to besmirch Wilson’s credibility, calling it “the most vicious hatchet job inside the Beltway since my colleague in Richard Nixon’s White House, the dirty trickster Charles W. Colson, copped a plea for defaming Daniel Ellsberg and his lawyer (see June 1974).… It was an obvious effort to discredit Wilson’s [Niger] report, and, Wilson believes, a you-hurt-us-we-will-hurt-you warning to others.” While Wilson writes with passion and anger about the outing of his wife, he restrains himself from giving too many personal details about her, relying instead on material already revealed in press interviews and reports. Dean notes that Wilson believes his wife’s name was leaked to the press by any or all of the following White House officials: Lewis “Scooter” Libby, the chief of staff to Vice President Dick Cheney; Karl Rove, Bush’s chief political strategist; and Elliott Abrams, a national security adviser and former Iran-Contra figure (see October 7, 1991). Though Dean is correct in noting that Wilson comes to his conclusions “based largely on hearsay from the Washington rumor mill,” he will be proven accurate in two out of three of his assertions (see July 8, 2003, 11:00 a.m. July 11, 2003, June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Wilson continues to fight attacks from Bush supporters, but, Dean notes, if they actually read his book, “they should understand that they have picked a fight with the wrong fellow.” [New York Times, 5/12/2004]

In a talk given at UCLA’s Center for International Relations, retired General Anthony Zinni, the former commander of the US military’s Central Command (CENTCOM - see April 17, 2003 and After and January 2003), discusses his early planning for the overthrow of Iraq’s Saddam Hussein and the inevitable chaos that would ensue, in plans called “Desert Crossing” (see April-July 1999). Zinni began working on the plans shortly after 1998’s “Desert Fox” bombing campaign (see December 16-19, 1998).
Plans to Overthrow, No Plans to Reconstruct - He recalls: “[I]t struck me then that we had a plan to defeat Saddam’s army, but we didn’t have a plan to rebuild Iraq. And so I asked the different agencies of government to come together to talk about reconstruction planning for Iraq.… I thought we ought to look at political reconstruction, economic reconstruction, security reconstruction, humanitarian need, services, and infrastructure development. We met in Washington, DC. We called the plan, and we gamed it out in the scenario, Desert Crossing.”
Many of Subsequent Problems Envisioned - Zinni says that he and his team envisioned many of the problems encountered after the March 2003 invasion and subsequent toppling of the Iraqi government: “The first meeting surfaced all the problems that have exactly happened now. This was 1999. And when I took it back and looked at it, I said, we need a plan. Not all of this is a military responsibility. I went back to State Department, to the Office of Foreign Disaster Assistance, Department of Commerce, and others and said, all right, how about you guys taking part of the plan. We need a plan in addition to the war plan for the reconstruction. Not interested. Would not look at it.” Zinni, he recalls, decided to have the plans created himself, “because I was convinced nobody in Washington was going to plan for it, and we, the military, would get stuck with it.”
Zinni Plans Ignored by Bush Planners - Before the invasion, he recalls, he recommended that the military planners go back and look at his plans: “When it looked like we were going in [to Iraq], I called back down to CENTCOM and said, ‘You need to dust off Desert Crossing.’ They said, ‘What’s that? Never heard of it.’ So in a matter of just a few years it was gone. The corporate memory. And in addition I was told, ‘We’ve been told not to do any of the planning. It would all be done in the Pentagon.’” Zinni’s original plans called for a civilian occupation authority with offices in all 18 Iraqi provinces; the current Coalition Provisional Authority only has one set of offices, in Baghdad’s Green Zone. And Zinni’s plans called for around 400,000 troops, instead of the 160,000 Defense Secretary Donald Rumsfeld approved. [John Prados, 11/4/2006]

[Source: CBS News]Retired Marine General Anthony Zinni was the chief of the US Central Command until 2000, and, until just before the invasion of Iraq, the Bush administration’s special envoy to the Middle East. Now he has become an outspoken critic of the administration’s war efforts in Iraq. Zinni gives an interview to CBS’s 60 Minutes, in part to promote his new biography, Battle Ready, co-authored by famed war novelist Tom Clancy.
'Dereliction of Duty' among Senior Pentagon Officials - Zinni says that senior officials at the Pentagon, from Defense Secretary Donald Rumsfeld on down, are guilty of what he calls dereliction of duty, and he believes it is time for “heads to roll.” Zinni tells correspondent Steve Kroft: “There has been poor strategic thinking in this. There has been poor operational planning and execution on the ground. And to think that we are going to ‘stay the course,’ the course is headed over Niagara Falls. I think it’s time to change course a little bit, or at least hold somebody responsible for putting you on this course. Because it’s been a failure.” In his book, Zinni writes: “In the lead up to the Iraq war and its later conduct, I saw at a minimum, true dereliction, negligence, and irresponsibility, at worse, lying, incompetence, and corruption.… I think there was dereliction in insufficient forces being put on the ground and fully understanding the military dimensions of the plan. I think there was dereliction in lack of planning.”
'The Wrong War at the Wrong Time' - Zinni calls Iraq “the wrong war at the wrong time,” and with the wrong strategy. Before the invasion, Zinni told Congress (see October 31, 2002): “This is, in my view, the worst time to take this on. And I don’t feel it needs to be done now.” The generals never wanted this war, Zinni says, but the civilians in the Pentagon and the White House did. “I can’t speak for all generals, certainly,” he says. “But I know we felt that this situation was contained (see Summer 2002-2003). Saddam was effectively contained.… And I think most of the generals felt, let’s deal with this one at a time. Let’s deal with this threat from terrorism, from al-Qaeda.”
Much Larger Force Required - Zinni was heavily involved in planning for any invasion of Iraq, going back to at least 1999 (see April-July 1999). Zinni always envisioned any such invasion as being implemented with enough ground forces to get the job done quickly and cleanly. Rumsfeld had different ideas—the invasion could be carried off with fewer troops and more high-tech weaponry. Zinni wanted around 300,000 troops: “We were much in line with General Shinseki’s view. We were talking about, you know, 300,000, in that neighborhood.” Would a larger force have made a difference? Kroft asks. Zinni replies, “I think it’s critical in the aftermath, if you’re gonna go to resolve a conflict through the use of force, and then to rebuild the country.” Rumsfeld should have anticipated the level and ferocity of violence that erupted in the aftermath of the toppling of the Hussein government, but, Zinni says, he did not, and worse, he ignored or belittled those such as Shinseki and a number of foreign allies who warned him of the possible consequences. Instead, Zinni notes, Rumsfeld relied on, among other sources, fabricated intelligence from Ahmed Chalabi and his Iraqi National Congress (see September 19-20, 2001).
'Seat of the Pants Operation' - The entire reconstruction effort was, in Zinni’s mind, a seat-of-the-pants affair. “As best I could see, I saw a pickup team, very small, insufficient in the Pentagon with no detailed plans that walked onto the battlefield after the major fighting stopped and tried to work it out in the huddle,” he says, “in effect to create a seat-of-the-pants operation on reconstructing a country.” Coalition Provisional Authority head L. Paul Bremer is “a great American who’s serving his country, I think, with all the kind of sacrifice and spirit you could expect. But he has made mistake after mistake after mistake.” Bremer’s mistakes include “Disbanding the army (see May 23, 2003). De-Baathifying (see May 16, 2003), down to a level where we removed people that were competent and didn’t have blood on their hands that you needed in the aftermath of reconstruction—alienating certain elements of that society.” Zinni reserves most of the blame for the Pentagon: “I blame the civilian leadership of the Pentagon directly.”
Heads Should Roll, Beginning with Rumsfeld's - Zinni continues: “But regardless of whose responsibility I think it is, somebody has screwed up. And at this level and at this stage, it should be evident to everybody that they’ve screwed up. And whose heads are rolling on this? That’s what bothers me most.” The first one to go, Zinni says, is Rumsfeld: “Well, it starts with at the top. If you’re the secretary of defense and you’re responsible for that.”
Neoconservatives at Fault - Next up are Rumsfeld’s advisers, whom Kroft identifies as the cadre of neoconservatives “who saw the invasion of Iraq as a way to stabilize American interests in the region and strengthen the position of Israel.” Zinni says: “Certainly those in your ranks that foisted this strategy on us that is flawed. Certainly they ought to be gone and replaced.” Kroft identifies that group as including Deputy Defense Secretary Paul Wolfowitz; Undersecretary of Defense Douglas Feith; former Defense Policy Board member Richard Perle; National Security Council member Elliott Abrams; and Vice President Cheney’s chief of staff, Lewis “Scooter” Libby. Zinni calls them political ideologues who have hijacked US policy in Iraq: “I think it’s the worst-kept secret in Washington. That everybody—everybody I talk to in Washington has known and fully knows what their agenda was and what they were trying to do.” Like so many others who criticized them, Zinni recalls, he was targeted for personal counterattacks. After publishing one article, he says: “I was called anti-Semitic. I mean, you know, unbelievable that that’s the kind of personal attacks that are run when you criticize a strategy and those who propose it.”
Fundamental Conceptual Flaws - Zinni says the neoconservatives believed they could remake the Middle East through the use of American military might, beginning with Iraq. Instead, the US is viewed in the region as “the modern crusaders, as the modern colonial power in this part of the world.”
Changing Course - Zinni has a number of recommendations. He advises President Bush and his senior officials to reach out much more strongly to the United Nations, and to US allies, and secure the UN’s backing. Do these other countries “want a say in political reconstruction? Do they want a piece of the pie economically? If that’s the cost, fine. What they’re gonna pay for up front is boots on the ground and involvement in sharing the burden.” Many more troops are needed on the ground, and not just American troops, he says, enough to seal off the borders, protect the road networks.
Exit Strategy - Zinni says that planning for an exit is necessary because it is inevitable that the US will want to withdraw, and that time will come sooner rather than later. “There is a limit,” he says. “I think it’s important to understand what the limit is. Now do I think we are there yet?”
Speaking Out - He is speaking out, he says, because it is his duty to do so: “It is part of your duty. Look, there is one statement that bothers me more than anything else. And that’s the idea that when the troops are in combat, everybody has to shut up. Imagine if we put troops in combat with a faulty rifle, and that rifle was malfunctioning, and troops were dying as a result. I can’t think anyone would allow that to happen, that would not speak up. Well, what’s the difference between a faulty plan and strategy that’s getting just as many troops killed?” [CBS News, 5/21/2004]

President Bush is interviewed for over an hour as part of the ongoing investigation into the Valerie Plame Wilson identity leak (see December 30, 2003). Bush, who is not sworn in, is interviewed by a team of federal prosecutors led by special counsel Patrick Fitzgerald. His lawyer, James Sharp (whom Bush has nicknamed “Shooter”), is also present during questioning (see June 5, 2004). White House press secretary Scott McClellan refuses to divulge any details of what Bush says to his interviewers, only telling reporters: “The leaking of classified information is a very serious matter. The president directed the White House to cooperate fully with those in charge of the investigation. He was pleased to do his part to help the investigation move forward.” Fitzgerald has already interviewed Vice President Dick Cheney (see May 8, 2004), and has called several current and former White House officials to testify before a grand jury. He has also subpoenaed a number of records, including White House phone logs. McClellan confirms that the interview with Bush and Sharp lasted about 70 minutes; asked if the White House had set a time limit on the interview, he says it would be “wrong to characterize it that way.” Even though Bush does not testify under oath, federal law requires him to be truthful in his statements, and he could be charged with making false statements if prosecutors found he lied or was evasive. Directly Contradicting Cheney - The media will later learn that Bush says he personally directed Cheney to lead a White House effort to counter allegations made by Plame Wilson’s husband, Joseph Wilson, that the White House had manipulated intelligence to make the case for war with Iraq (see March 9, 2003 and After). Bush also admits that he directed Cheney to disclose classified information that would both defend his administration and discredit Wilson. His testimony directly contradicts Cheney’s. Bush says he did not know that Cheney had told his then-chief of staff, Lewis “Scooter” Libby, to covertly leak the classified information to the media instead of releasing it to the public in the usual, overt fashion.
Denies Instructing Subordinates to Leak Plame Wilson Info - He also denies telling anyone to reveal Plame Wilson’s CIA status, and says he does not know who in his administration made her CIA status public knowledge. Libby has testified that neither Bush nor Cheney directed him or any other White House official to leak Plame Wilson’s identity. According to one senior government official, Bush told Cheney to “Get it out,” or “Let’s get this out,” regarding information that administration officials believed would rebut Wilson’s allegations and would discredit him. Another source with direct knowledge of the interview will later say that characterization is consistent with what Bush tells Fitzgerald. Libby told the grand jury that Cheney had told him to “get all the facts out” to defend the administration and besmirch Wilson. [National Journal, 7/3/2006]

The Coalition Provisional Authority (CPA - see April 17, 2003 and After and January 2003) notes in an internal report that while it lacks an accurate personnel count, it “believe[s] it had a total of 1,196 workers” in Baghdad, about half the authorized number. The Pentagon made up the shortfall by turning to the White House Liaison Office to recruit workers. The Liaison Office normally vets political appointees, and is staffed by right-wing ideologues with little practical experience outside Washington. As a result, the Liaison Office has sent hundreds of recruits to Baghdad who, in the phrasing of the CPA Inspector General, have “inconsistent skill sets.” Author and public policy professor Alasdair Roberts later notes that what the recruits lack in experience, ability, and qualifications, they make up in dogmatic adherence to right-wing ideology. One telling example is the group of CPA workers who manage the multi-billion dollar budget for the Iraqi government. Few, if any, have ever been to the Middle East, nor do any of them speak any of the region’s languages. None have any experience handling budgets of any real size. They are a group of recent college graduates, all in their twenties, who had submitted resumes for unrelated, lower-level jobs through the conservative Heritage Foundation. Roberts later writes, “The inexperience and partisanship of many CPA workers encouraged them to seize the moment and pursue reforms that were unneeded or impractical,” implementing what Roberts calls a “radical reconstruction of Iraqi society” based on neoconservative and fundamentalist dogma, with no understanding of, or concern for, Iraqi society. Many of the proposed reforms are later shelved as unworkable and dangerously provocative; one plan, to privatize Iraq’s state-run enterprises, is set aside for fear that it would lead to “popular unrest.” Most of the staff spend little time in Iraq before returning home; one CPA adviser calls them “90-day wonders getting their tickets punched that said, ‘I’ve been in Baghdad.’” [Roberts, 2008, pp. 127-128]

Richard Ben-Veniste, a Democratic member of the 9/11 Commission, insists that the commission properly interview two CIA analysts who drafted an August 2001 Presidential Daily Brief (PDB) item entitled “Bin Laden Determined to Strike in US” (see August 6, 2001). Ben-Veniste makes the demand after he learns that Commission Executive Director Philip Zelikow interviewed one of the analysts by phone, but allegedly pressured the analyst to back the White House version of events (see June 2004). Initially, Ben-Veniste asks to see transcripts of interviews with the analysts. However, according to author Philip Shenon: “With a condescending tone that reflected his disdain for Ben-Veniste, Zelikow explained matter-of-factly that there weren’t any transcripts…. After months of battles with Zelikow, it was hard for Ben-Veniste to be shocked by almost anything he did. But the staff could see that Ben-Veniste was genuinely startled.” Ben-Veniste’s demand for full interviews is opposed by Zelikow, who says that one of the analysts, known only as Barbara S, has already been interviewed (although it is unclear how much of this interview was focused on the PDB). Zelikow will also say, “The CIA was pleading with us not to do this, since the career people involved in preparing and presenting PDBs would be intimidated, disrupting the sense of confidentiality and candor they considered essential for the PDB process.” However, when they are interviewed, the two analysts seem eager to volunteer the information they have. The commission’s Democratic Vice Chairman Lee Hamilton, who has a record of siding with the Republicans (see Before November 27, 2002 and March 2003-July 2004) fails to back Ben-Veniste before the full commission. Republican Chairman Tom Kean rescues him, pushing through the request for the interviews in the face of opposition from the other Republicans on the commission (see July 13, 2004). [Source: PBS]The Senate Intelligence Committee releases the 511-page Senate Report on Iraqi WMD intelligence, formally titled the “Report of the Select Committee on Intelligence on the US Intelligence Community’s Prewar Intelligence Assessments on Iraq.” [US Congress, 7/7/2004; CNN, 7/9/2004] All nine Republicans and eight Democrats signed off on the report without dissent, which, as reporter Murray Waas will write, is “a rarity for any such report in Washington, especially during an election year.” [National Journal, 10/27/2005]
Report Redacted by White House - About 20 percent of the report was redacted by the White House before its release, over the objections of both Republicans and Democrats on the committee. Some of the redactions include caveats and warnings about the reliability of key CIA informants, one code-named “Red River” and another code-named “Curveball” (see Mid- and Late 2001). The source called “Red River” failed polygraph tests given to him by CIA officers to assess his reliability, but portions of the report detailing these and other caveats were redacted at the behest of Bush administration officials. Widespread Failures of US Intelligence - The report identifies multiple, widespread failures by the US intelligence community in its gathering and analysis of intelligence about Iraq WMD, which led to gross misunderstandings and misrepresentations about Iraq’s WMD programs to the American public by government officials. Committee chairman Pat Roberts (R-KS), who has previously attempted to shift blame for the intelligence misrepresentations away from the Bush administration and onto the CIA (see July 11, 2003 and After), says that intelligence used to support the invasion of Iraq was based on assessments that were “unreasonable and largely unsupported by the available intelligence.” He continues: “Before the war, the US intelligence community told the president as well as the Congress and the public that Saddam Hussein had stockpiles of chemical and biological weapons and if left unchecked would probably have a nuclear weapon during this decade. Today we know these assessments were wrong.” Senator John D. Rockefeller (D-WV), the ranking Democrat on the 18-member panel that created the report, says “bad information” was used to bolster the case for war. “We in Congress would not have authorized that war with 75 votes if we knew what we know now,” he says (see October 10, 2002). “Leading up to September 11, our government didn’t connect the dots. In Iraq, we are even more culpable because the dots themselves never existed.” Numerous assertions in an October 2002 National Intelligence Estimate (NIE—see October 1, 2002) were “overstated” or “not supported by the raw intelligence reporting,” including:
bullet Claims that Iraq was rebuilding its nuclear weapons program;
bullet Claims that Iraq had large stockpiles of chemical and biological weapons;
bullet Claims that Iraq was developing an unmanned aerial vehicle that could be used to deliver chemical and/or biological weapons payloads onto distant targets;
bullet The so-called “layering effect,” where “assessments were based on previous judgments, without considering the uncertainties of those judgments” (Roberts calls it an “assumption train”);
bullet The failure to explain adequately the uncertainties in the October 2002 NIE to White House officials and Congressional lawmakers;
bullet Reliance on claims by “Curveball,” noting that the use of those claims “demonstrated serious lapses in handling such an important source”;
bullet Use of “overstated, misleading, or incorrect” information in helping then-Secretary of State Colin Powell present the administration’s case to the United Nations in February 2003 (see February 5, 2003); and
bullet The failure of the CIA to share significant intelligence with other agencies. [CNN, 7/9/2004; Cybercast News Service, 7/9/2004; New York Times, 7/9/2004]
“One fact is now clear,” Roberts says. “Before the war, the US intelligence community told the president as well as the Congress and the public that Saddam Hussein had stockpiles of chemical and biological weapons, and if left unchecked, would probably have a nuclear weapon during this decade. Well, today we know these assessments were wrong.” [Cybercast News Service, 7/9/2004; New York Times, 7/9/2004] Rockefeller says the intelligence community failed to “accurately or adequately explain the uncertainties behind the judgments in the October 2002 National Intelligence Estimate to policymakers.” The community’s “intelligence failures” will haunt America’s national security “for generations to come,” he says. “Our credibility is diminished. Our standing in the world has never been lower,” he says. “We have fostered a deep hatred of Americans in the Muslim world, and that will grow. As a direct consequence, our nation is more vulnerable today than ever before.” [CNN, 7/9/2004; New York Times, 7/9/2004]
'Group Think' and 'Corporate Culture' - Roberts says the report finds that the “flawed” information used to send the nation to war was the result of “what we call a collective group think, which led analysts and collectors and managers to presume that Iraq had active and growing WMD programs.” He says this “group think caused the community to interpret ambiguous evidence, such as the procurement of dual-use technology, as conclusive evidence of the existence of WMD programs.” Roberts blames “group think” and a “broken corporate culture and poor management,” which “cannot be solved by simply adding funding and also personnel.” [CNN, 7/9/2004; New York Times, 7/9/2004]
Lack of Human Intelligence in Iraq - Perhaps the most troubling finding, Roberts says, is the intelligence community’s near-total lack of human intelligence in Iraq. “Most alarmingly, after 1998 and the exit of the UN inspectors, the CIA had no human intelligence sources inside Iraq who were collecting against the WMD target,” he says. [CNN, 7/9/2004; New York Times, 7/9/2004]
No Connection between Iraq, al-Qaeda - Rockefeller says that the administration’s claims of an alliance between Iraq’s Saddam Hussein and al-Qaeda had no basis in fact: “[N]o evidence existed of Iraq’s complicity or assistance in al-Qaeda’s terrorist attacks, including 9/11.” The report says that intelligence claims of connections between Iraq and some terrorist activities were accurate, though the contacts between al-Qaeda and Iraq from the 1990s “did not add up to an established formal relationship.” [CNN, 7/9/2004; New York Times, 7/9/2004]
Divided Opinion on Pressure from Bush Administration - Republicans and Democrats on the committee differ as to whether they believe the CIA and other intelligence agencies groomed or distorted their findings as a result of political pressure from the White House. “The committee found no evidence that the intelligence community’s mischaracterization or exaggeration of intelligence on Iraq’s weapons of mass destruction capabilities was the result of politics or pressure,” Roberts says. However, Rockefeller notes that the report fails to explain fully the pressures on the intelligence community “when the most senior officials in the Bush administration had already forcefully and repeatedly stated their conclusions publicly. It was clear to all of us in this room who were watching that—and to many others—that they had made up their mind that they were going to go to war.” The analysts were subjected to a “cascade of ominous statements,” Rockefeller says, that may have pushed them to slant their analyses in the direction the White House indicated it wanted. The report finds that Vice President Dick Cheney and others who repeatedly visited intelligence agencies (see 2002-Early 2003) pressured intelligence analysts or officials to present particular findings or change their views. However, the report notes repeated instances of analysts exaggerating what they knew, and leaving out, glossing over, or omitting dissenting views. According to the report, the intelligence community released a misleading public version of the October 2002 NIE (see October 4, 2002) that eliminated caveats and dissenting opinions, thus misrepresenting “their judgments to the public which did not have access to the classified National Intelligence Estimate containing the more carefully worded assessments.” [CNN, 7/9/2004; New York Times, 7/9/2004; Cybercast News Service, 7/9/2004] In an interview the evening after the report’s release, Rockefeller is asked if the report documents “a failure of a system or is this a failure of a bunch of individuals who just did their jobs poorly?” Rockefeller responds: “This is a failure of a system.… It is not fair to simply dump all of this on the Central Intelligence Agency. The Central Intelligence Agency does not make the decision, and [former Director] George Tenet does not make the decision to go to war. That decision is made at the other end of Pennsylvania Avenue.… So we went to war under false pretenses, and I think that is a very serious subject for Americans to think about for our future.” Asked “if the president had known then what he knows now, he would have still taken us to war?” Rockefeller answers: “I can’t answer that question. I just ask—the question I ask is, why isn’t he, and maybe he is, why isn’t he as angry about his decision, so to speak his vote on this, as I am about mine?” [PBS, 7/9/2004]
Supporting the Claim of Iraq's Attempt to Purchase Nigerien Uranium - The report states flatly that senior CIA case officer Valerie Plame Wilson made the decision to send her husband, former ambassador Joseph Wilson, to Niger to investigate false claims that Iraq had attempted to purchase uranium from that nation (see February 21, 2002-March 4, 2002). The CIA has demonstrated that Plame Wilson did not make that decision (see February 19, 2002). However, as well as claiming that Plame Wilson sent Wilson to Niger, it claims that Wilson’s report, far from disproving the assertion of an attempt by Iraq to purchase uranium, actually bolstered that assertion. The report states that the question of Iraq’s attempt to buy Nigerien uranium remains “open.” It also says Wilson lied to the Washington Post in June 2004 by claiming that the documents used to support the claim were forgeries (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003). “Committee staff asked how the former ambassador could have come to the conclusion that the ‘dates were wrong and the names were wrong’ when he had never seen the CIA reports and had no knowledge of what names and dates were in the reports,” the report states. Wilson told committee members he may have been confused and may have “misspoken” to some reporters (see May 2, 2004). The committee did not examine the documents themselves. [Washington Post, 7/10/2009] The committee made similar claims a year before (see June 11, 2003 and July 11, 2003 and After). Progressive reporter and columnist Joshua Micah Marshall disputes the report’s claim that Wilson’s trip to Niger actually helped prove the assertion that Iraq tried to buy Nigerien uranium. The intelligence reports making the assertion are “fruits of the same poison tree” that produced so many other false and misleading claims, Marshall writes, and were based on the assumption that the forged documents were genuine. [Joshua Micah Marshall, 7/10/2004] In 2007, Plame Wilson will write, “What was missing from the [committee] report was just as telling as the distortions it contained. The ‘Additional Views’ section… had concluded” that she was responsible for sending Wilson to Niger. Yet that was contradicted by a senior CIA official over a year before. Plame Wilson will call the “Additional Views” section “a political smear if there ever was one,” crammed with “distortions and outright lies. Yet it continues to be cited today by Joe’s critics as proof of his lack of credibility.” The Wilsons learn months later that committee Democrats decided not to fight against the attacks on Wilson’s integrity; according to one of the senior Democratic senators on the panel, there was simply too much “incoming” from the Republicans for them to fight every issue. There were “far too many serious substantial disputes” that needed solving, and the Democrats chose to allow the attacks on Wilson to proceed without comment. [Wilson, 2007, pp. 187-190]
Portion of the Report Delayed - Roberts and other Republican majority committee members were successful in blocking Democrats’ attempts to complete the second portion of the report, which delineates the Bush administration’s use of the intelligence findings. That report will not be released until after the November 2004 presidential election. Rockefeller says he feels “genuine frustration… that virtually everything that has to do with the administration” has been “relegated to phase two” and will be discussed at another time. The second part of the committee’s investigation will focus on the “interaction or the pressure or the shaping of intelligence” by the Bush administration, Rockefeller says. “It was clear to all of us that the Bush administration had made up its mind to go to war,” he says, and he believes that such a “predetermination” influenced the intelligence community. Representative Jane Harman (D-CA), the ranking member of the House Intelligence Committee, says she hopes a similar House investigation would address some of those issues. However, she notes, she has been stymied by House Republicans in even launching that investigation. “There has not been the cooperation that there apparently has been on the Senate side,” she says. She has just now managed to wangle a meeting with House Intelligence Committee chairman Porter Goss (R-FL), who is being touted as the next director of the CIA (see September 24, 2004). Harman says, “I would hope we could address [the issues] factually and on a bipartisan basis, but at the moment I don’t have a lot of confidence in it.” [CNN, 7/9/2004; Cybercast News Service, 7/9/2004] Roberts’s spokeswoman Sarah Little later says that the committee has not yet decided whether the second portion of the report will be fully classified, declassified, or even if it will hold hearings. [National Journal, 10/27/2005]
Cheney, Roberts Colluded in Interfering with Report - Over a year later, the media will find that Roberts allowed Cheney and members of his staff to interfere with the committee’s investigation and dramatically limit its scope (see October 27, 2005). Rockefeller will say that he made three separate requests for White House documents during the committee’s investigation, but never received the documents he asked for. “The fact is,” Rockefeller will say, “that throughout the Iraq investigation any line of questioning that brought us too close to the White House was thwarted.” Rockefeller’s spokesperson, Wendy Morigi, will say that Rockefeller will “sadly come to the conclusion that the Intelligence Committee is not capable of doing the job of investigating the fundamental question as to whether the administration has misused intelligence to go to war.” [National Journal, 10/30/2005] Plame Wilson will write: “In the coming months, many reliable sources told us that before the report was issued, there was considerable collusion between the vice president’s office and… Roberts on how to craft the report and its content. So much for checks and balances and the separation of powers.” [Wilson, 2007, pp. 192]

Author Clifford May, a former Republican National Committee staffer and a well-known television pundit, lambasts former ambassador Joseph Wilson’s new book, The Politics of Truth (see April 2004). May, who has written derisively about Wilson before (see September 29, 2003), opens by accusing Wilson of publishing a “quickie book sporting his dapper self on the cover” that contains little substance and is based largely on “a wet-kiss profile in Vanity Fair.” He derides Wilson’s lengthy experience as a diplomat (see July 31, 1990, August 1-2, 1990, August 6, 1990, August 8-9, 1990, September 20, 1990, and January 12, 1991) by calling him “the guy who makes sure the embassy plumbing is working and that the commissary is stocked with Oreos and other products the ambassador prefers.” Most notably, May comes to the conclusion that Wilson himself, and not the White House, outed his wife Valerie Plame Wilson as a CIA agent, a conclusion he says was reached by a “bipartisan Senate committee report.” May is referring to the recent report by the Senate Intelligence Committee (see July 9, 2004). He repeats many of the committee’s erroneous assertions, including the allegation that Wilson’s wife was responsible for the decision to send Wilson to Niger (see February 19, 2002, July 22, 2003, and October 17, 2003). In regards to President Bush’s State of the Union assertion that Iraq had attempted to buy uranium from Niger (see Mid-January 2003 and 9:01 pm January 28, 2003), May writes, “We now know for certain that Wilson was wrong and that Bush’s statement was entirely accurate.” He goes on to assert that the forged documents used to support the Iraq-Niger uranium story were likely “planted in order to be discovered—as a ruse to discredit the story of a Niger-Iraq link, to persuade people there were no grounds for the charge. If that was the plan, it worked like a charm.” May even says that Wilson’s report bolstered the belief that the uranium story might be true. He repeats his earlier charges that Wilson is an incompetent partisan whom the CIA had no business sending to Niger in the first place. He never explains exactly how Wilson outed his own wife as a CIA agent, though he does assert, wrongly, that Plame Wilson was never an undercover agent (see Fall 1992 - 1996) and therefore no one broke the law in revealing her status as a CIA official. [National Review, 7/12/2004] In 2004, Wilson will write of May’s assertion that his wife’s CIA status “was supposedly widely known” throughout Washington, “[I]f what May wrote was accurate, it is a damning admission, because it could have been widely known only by virtue of leaks among his own crowd.” [Wilson, 2004, pp. 443-444]

Despite a claim by the Commission’s Executive Director Philip Zelikow that the analysts, known only as Barbara S and Dwayne D, were reluctant to answer questions, they are willing and eager to respond to Ben-Veniste.
PDB Item Not 'Historical' - According to author Philip Shenon, the analysts are “confused” and “appalled” by claims by National Security Adviser Condoleezza Rice and others at the White House that the PDB item only contained an “historical” overview of domestic terrorism threats. The analysts say that this was not its purpose and that it was supposed to remind President Bush that al-Qaeda remained a dire threat in August 2001 and that a domestic attack was certainly a possibility. For example, the item referred to “patterns of suspicious activity in this country consistent with preparations for hijackings or other types of attacks.” Barbara S says, “That’s not historical,” and adds the threat of a domestic terror attack by al-Qaeda was thought “current and serious” at that time.
Ordered up 'In-House' - In addition, the analysts say that another claim made by the White House, that President Bush specifically ordered the PDB (see April 13, 2004), is false. They state that the PDB item was ordered “in-house” by the CIA in the hope that the White House would pay more attention to the threat. However, President Bush had asked his intelligence briefers about the possibility of a domestic attack by terrorists that summer (see July 5, 2001).
Zelikow Objects to Placement of Material in Final Report - Ben-Veniste insists that the material from the two analysts is placed prominently in the Commission’s final report, although Zelikow objects to this. After negotiations, the relevant paragraph will read as follows: “During the spring and summer of 2001, President Bush had on several occasions asked his briefers whether any of the threats pointed to the United States. Reflecting on these questions, the CIA decided to write a briefing article summarizing its understanding of this danger. Two CIA analysts involved in preparing this briefing article believed it represented an opportunity to communicate their view that the threat of a bin Laden attack in the United States remained both current and serious. The result was an article in the August 6 Presidential Daily Brief titled ‘Bin Laden Determined to Strike in US.’” [Shenon, 2008, pp. 377-379]

Conservative columnist Robert Novak, who outed Valerie Plame Wilson’s covert CIA status in a column a year earlier (see July 14, 2003), regarding the recently released Senate Intelligence Committee report on the administration’s use of intelligence to justify the invasion of Iraq (see July 9, 2004), observes that its “most remarkable aspect… is what its Democratic members did not say.” Novak claims that committee Democrats do not dispute that Iraq tried to discuss purchasing yellowcake uranium from Niger. They did not agree to the report’s conclusion that Plame Wilson suggested her husband, Joseph Wilson, for a fact-finding mission to Niger, a conclusion that is false (see February 19, 2002, July 22, 2003, October 17, 2003, and Mid-July, 2004), but neither did they defend Wilson’s denials of his wife’s involvement. Novak writes: “According to committee sources, Roberts felt Wilson had been such a ‘cause celebre’ for Democrats that they could not face the facts about him.… Now, for Intelligence Committee Democrats, it is as though the Niger question and Joe Wilson have vanished from the earth.” [CNN, 7/15/2004]

White House chief of staff Andy Card learns what the 9/11 Commission Report contains before it is published, as the various chapters are sent to the White House for classification review before the publication date. Card then hears back from the review teams. Despite fears about allegations made by former counterterrorism “tsar” Richard Clarke (see March 21, 2004) and a key Presidential Daily Brief item (see August 6, 2001), in the words of author Philip Shenon, Card can see “that the Commission’s final report posed no threat to [President] Bush’s re-election.” This is because the report does not “single out individuals for blame. Certainly not George Bush.” The allegations by Clarke, related in a “he-said, she-said” manner in the report, also do not damage National Security Adviser Condoleezza Rice. [Shenon, 2008, pp. 411]

The Wall Street Journal publishes an op-ed declaring that since the Senate Intelligence Committee has “exposed” former ambassor Joseph Wilson’s “falsehoods” about his trip to Niger to explore the allegations that Iraq tried to purchase uranium from Niger (see July 9, 2004), it is time for Special Prosecutor Patrick Fitzgerald to “close up shop” and stop his investigation into who outed Wilson’s wife, CIA agent Valerie Plame Wilson. The Journal declares that if “an administration official cited nepotism truthfully in order to explain the oddity of Mr. Wilson’s selection for the Niger mission, then there was no underlying crime” in outing Plame Wilson. “[T]he entire leak probe now looks like a familiar Beltway case of criminalizing political differences. Special Prosecutor Patrick Fitzgerald should fold up his tent.” The Journal also repeats the baseless conclusion of the Republican authors of the committee report that stated Wilson’s findings in Niger actually provided “some confirmation” of the Iraq-Niger deal. She recalls realizing that the entire thrust of the attempt to smear her husband is “to derail the leak investigation, which was sniffing dangerously close to the White House. London’s Sunday Times interviews the person it calls “a mysterious middleman who was a key figure in the notorious Niger uranium hoax before the Iraq war.” The middleman is information peddler Rocco Martino, though Martino uses the alias “Giacomo” in the interview. He claims to have been an “unwitting dupe” in the passing of forged documents alleging that Iraq attempted to buy uranium from Niger (see Early 2000). Martino confirms that he has worked as a low-level agent for the Italian military intelligence service SISMI, and says that the agency used him to spread the forged Iraq-Niger documents. “I received a call from a former colleague in SISMI,” he says. “I was told a woman in the Niger embassy in Rome had a gift for me. I met her and she gave me documents. Sismi wanted me to pass on the documents but they didn’t want anyone to know they had been involved.” Martino is referring to Laura Montini, another SISMI asset (see March 2000). He says he believed the documents were real when he gave them to various intelligence contacts and journalist Elisabetta Burba (see Afternoon October 7, 2002). A lawsuit, Doe v. Rumsfeld, is filed on behalf of an Army recruit who is being forcibly redeployed to Iraq after nine years of active duty under the Army’s “stop-loss” program (see November 2002). The plaintiff, a reservist in the California National Guard who uses the pseudonym “John Doe” in the lawsuit, claims that since he signed up for only one year of duty, the stop-loss deployment could force him “to return to Iraq for up to two years, and possible continued military service beyond that time.” [PBS, 9/17/2004] Doe is a married father of two and an eight-year Army veteran who served in combat during the 1991 Gulf War (see January 16, 1991 and After). Doe enlisted in the National Guard in May 2003 under the so-called “Try One” program, which allows active-duty veterans to sign up for a year before deciding to make a longer commitment. Doe renewed in February 2004, making his new expiration date May 2, 2005. In July 2004, Doe’s unit was deployed for a 545-day tour of duty, which extended Doe’s time in service by about a year. He says he was told that if he did not re-enlist voluntarily for the extra time, he would be retained under the Army’s stop-loss policy. Western intelligence officials say that a French intelligence operation to protect Niger’s uranium industry and to prevent weapons proliferation is the inadvertent cause of the forged documents alleging a surreptitious attempt by Iraq to procure uranium from Niger. The operation began in 1999, the officials say. In 2000, French intelligence officials received documents from Italian information peddler Rocco Martino, a source they had used before, that indicated Iraq wanted to expand economic “trade” with Niger. The intelligence officials assumed Iraq wanted to trade for uranium, Niger’s main export. Alarmed, the French asked Martino to provide more information, which, the Financial Times reports, “led to a flourishing ‘market’ in documents.” The next documents Martino provided to the French were forgeries, later exposed as such by inspectors from the International Atomic Energy Agency (see March 7, 2003). The US, which used the documents to support President Bush’s claim that Iraq had attempted to buy uranium from Niger in his 2003 State of the Union address (see Mid-January 2003 and 9:01 pm January 28, 2003), later disavowed the claim; the British have yet to do so, insisting that they have other evidence showing the truth behind the allegations. Martino recently confirmed that the documents originated from contacts provided to him by Italian intelligence (see Late July, 2004). A Western intelligence official says: “This issue shows how vulnerable intelligence services and the media are to tricksters like Martino. He responded to a legitimate… demand from the French, who needed the information on Niger. And now he is responding to a new demand in the market, which is being dictated by the political importance this issue has in the US. The Federal Election Commission (FEC) dismisses the complaint “Citizens United v. Michael Moore and Fahrenheit 9/11.” The conservative lobbying group Citizens United (CU—see (May 11, 2004)) had complained to the Federal Election Commission (FEC) that liberal documentarian Michael Moore released a movie, Fahrenheit 9/11 (see June 25, 2004), that was so critical of the Bush administration that it should be considered political advertising. If the movie is indeed political advertising, under federal law it cannot be shown within 30 days before a primary election or 60 days before a general election. The FEC dismisses the complaint, finding no evidence that the movie’s advertisements had broken the law. The movie’s distributors, Lions Gate, assure the FEC that they do not intend to advertise the movie during the time periods given under the law. [Federal Election Commission, 8/6/2004; Moneyocracy, 2/2012] In the aftermath of the FEC decision, CU leaders Floyd Brown (see September 21 - October 4, 1988) and David Bossie will decide that they can do what Moore did, and decide to make their own “documentaries.” Bossie realized after Fahrenheit 9/11 aired that it, and the television commercials promoting it, served two purposes—attacking President Bush and generating profits. Having already conducted an examination of the career of former First Lady Hillary Clinton (D-NY), now a sitting senator with presidential aspirations, the organization will decide to make its first “feature film” about her (see January 10-16, 2008). The grand jury investigating the leak of Valerie Plame Wilson’s covert CIA identity (see December 30, 2003) subpoenas New York Times reporter Judith Miller to testify. Unusual Negotiations between Lawyers - The subpoena will open a lengthy and sometimes puzzling set of negotiations between lawyers for Miller and her source, White House aide Lewis “Scooter” Libby. Miller refuses to divulge the identity of her source or the contents of their conversations (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). But she sends her lawyer, Floyd Abrams, to talk to Libby’s lawyer, Joseph Tate, to see if Libby will approve of her testimony. According to Abrams and others involved in the negotiations, Tate initially tells Abrams that Miller is free to testify. However, Abrams will say, Tate says that Libby never told Miller the name or the undercover status of Plame Wilson. This raises a conflict for Miller: her notes clearly indicate that she was told three times about Plame Wilson’s identity. If she testifies, she will contradict Libby’s own accounts of their conversations.
Libby Attempting to Influence Miller? - Miller decides that Libby is sending her a signal not to testify. She will later recalls Abrams’s recounting of his conversation with Tate: “He was pressing about what you would say. When I wouldn’t give him an assurance that you would exonerate Libby, if you were to cooperate, he then immediately gave me this, ‘Don’t go there, or, we don’t want you there.’” Abrams himself will recall: “On more than one occasion, Mr. Tate asked me for a recitation of what Ms. Miller would say. I did not provide one.” (Tate will angrily dispute both Abrams’s and Miller’s recollections, saying: “I never once suggested that she should not testify. It was just the opposite. I told Mr. Abrams that the waiver was voluntary.… ‘Don’t go there’ or ‘We don’t want you there’ is not something I said, would say, or ever implied or suggested.”) Miller’s executive editor, Bill Keller, will later say that Miller believed Libby feared her testimony. “Judy believed Libby was afraid of her testimony,” he will recall. “She thought Libby had reason to be afraid of her testimony.” Because of these reasons, Miller will decide not to further pursue the idea of a waiver from Libby that would allow her to testify about their conversations. For over a year, the two sides do not speak to one another. “I interpreted the silence as, ‘Don’t testify,’” Miller will later say. Tate will counter that he never understood why Miller or Abrams wanted to discuss the matter further. [New York Times, 10/16/2005]
McClellan: Fighting to Protect Partisan Government Leakers - In 2008, one-time White House press secretary Scott McClellan will write of Miller and fellow journalist Matthew Cooper, also battling a subpoena (see August 9, 2004): “Of course, there was a curious twist to the defense used by Cooper and Miller. By refusing to divulge the names of their sources in the leak case, the two reporters were not protecting courageous whistle-blowers revealing government wrongdoing in the public interest. Rather, they were shielding government officials whom administration critics believed had used leaks as weapons of partisan warfare. It was hard for some in the public, and especially those critical of the administration, to see this as an act of journalism.… This episode… seemed to confirm for at least some administration critics that reporters were no longer heroic figures, but were now participating in the same partisan warfare they created.” [McClellan, 2008, pp. 256]

Former ambassador Joseph Wilson, under fire for his 2002 findings that there was no truth to the reports that Iraq had tried to buy uranium from Niger (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003), speaks at several events arranged by his literary agent in Martha’s Vineyard, Massachusetts. He and his wife are disappointed that many invitees decline to come based on the recent smear campaign against him—his wife, Valerie Plame Wilson, will write in 2007, “[I]t suddenly struck me that we had officially become pariahs”—but some do attend Wilson’s short, impassioned presentations. At a book signing at a local library, Wilson asks the attendees if anyone knows who put the infamous “sixteen words” into President Bush’s State of the Union address (see Mid-January 2003 and 9:01 pm January 28, 2003). No one raises a hand. He then asks if anyone does not know the name of his wife. Again, no hands. Wilson asks: “What’s wrong with this picture? Nobody knows who put a lie in the president’s mouth, yet everybody knows the name of a covert CIA officer simply because she is married to a man who had the temerity to challenge the administration.” [Wilson, 2007, pp. 196-199]

Time reporter Matthew Cooper, facing jail time for refusing to honor a subpoena issued by the grand jury investigating the Valerie Plame Wilson CIA identity leak (see August 9, 2004), agrees to make a deposition after his source, vice-presidential chief of staff Lewis Libby, releases him from a confidentiality pledge (see August 5, 2004). [Washington Post, 7/3/2007; Washington Post, 7/3/2007] Following Cooper’s agreement to testify, contempt charges against him are dismissed. [PBS, 8/24/2004; Washington Post, 8/25/2004] Time managing editor Jim Kelly will later say: “Matt would have gone to jail if Libby didn’t waive his right to confidentiality… and we would have fought all the way to the Supreme Court. Matt has been absolutely steadfast in his desire to protect anonymous sources.” [Washington Post, 8/25/2004] In the deposition, Cooper describes a conversation he had with Libby concerning Plame Wilson’s identity. Cooper will later describe his conversation in an article for Time that will recount his deposition as well as his July 2005 grand jury testimony (see July 13, 2005). According to Cooper, the conversation with Libby was originally on the record, but “moved to background.” On the record, Libby denied that Vice President Cheney knew about, or played any role in, sending Joseph Wilson to Niger (see (February 13, 2002)). On background, Cooper asked Libby if he had heard anything about Wilson’s wife sending her husband to Niger. Libby replied, “Yeah, I’ve heard that too,” or something similar. Cooper says that Libby did not use Plame Wilson’s name. Nor did he indicate that he had learned her name from other reporters, as Libby has claimed (see March 5, 2004, March 24, 2004, and July 10 or 11, 2003). The DVD cover for ‘Celsius 41.11.’The DVD cover for ‘Celsius 41.11.’ [Source: Citizens United]The Federal Election Commission (FEC) refuses to allow the conservative lobbying and advocacy group Citizens United (CU) to advertise on television its upcoming film Celsius 41.11—The Temperature at Which the Brain Begins to Die, a documentary that the group intends as a refutation of the documentary Fahrenheit 9/11 (see June 25, 2004), a film by liberal documentarian Michael Moore that savaged the Bush administration’s handling of the 9/11 attacks. The FEC also refuses to allow CU to pay to run the film on television. The FEC bases its decision on the Bipartisan Campaign Reform Act of 2002 (McCain-Feingold—see March 27, 2002), and its restrictions on nonprofit groups such as CU using unregulated contributions to pay for “electioneering communications” to be shown within 60 days of a federal general election. CU would broadcast the film in late September, less than 60 days before the November 2 elections. CU argued, unsuccessfully, that it is a member of the news media and therefore can use a legal exemption provided for news, commentary, and editorial content. In a 4-0 vote, the FEC rejects the argument, saying that CU intends to buy air time instead of being paid to provide content, and that its primary function is as an advocacy group and not a film production organization. FEC vice chair Ellen L. Weintraub, one of the commission’s three Democrats, says: “You don’t want a situation where people are airing campaign commercials and they are exempt from commission rules because they are considered a media event. The danger is that the exemption swallows the rules.” CU president David Bossie (see May 1998) says he is “clearly disappointed” with the ruling, and adds, “They [the FEC] want to limit free speech, and that’s what this issue is about for us.” The company marketing Fahrenheit 9/11 was not allowed to run advertisements promoting the film within 60 days of the elections, and a CU complaint against that film was dismissed after its distributors promised not to air such advertisements (see August 6, 2004). CU has helped fund the publication of a book by Bossie attacking Democratic presidential candidate John Kerry (D-MA), and has released numerous documentaries attacking the Clinton administration and the United Nations. The current film contains some material attacking Kerry, though that material is not the primary focus of the film. The New York Times reports on the recent issuance of a new National Intelligence Estimate (NIE) on Iraq by the US intelligence community. It is the first NIE to be issued since before the invasion (see October 1, 2002). The report was leaked to the Times by unnamed government officials.
Civil War a Strong Possibility - The NIE’s findings are grim. Civil war is a strong possibility, the NIE finds. Even the best-case scenario is an Iraq whose political, economic, and national security stability is tenuous and fragile. One government official says of the report, “There’s a significant amount of pessimism.” This NIE was initiated by the National Intelligence Council under the aegis of then-CIA Director George Tenet, who has since resigned. Acting CIA Director John McLaughlin approved the final report. The NIE stands in contrast to recent pronouncements by White House officials, who have insisted that the situation in Iraq is improving daily.
Critics 'Pessimists and Hand-Wringers' - The day before the NIE was released, White House press secretary Scott McClellan called critics of the occupation “pessimists and hand-wringers” who are being “proven… wrong.” [New York Times, 9/16/2004]
White House Ignores NIE - The NIE was prepared in July 2004 and not circulated until August, indicating that the White House had little use for the document. “It was finished in July, and not circulated by the intelligence community until the end of August,” one senior administration official says. “That’s not exactly what you do with an urgent document.” [New York Times, 9/28/2004]
This NIE Closer to CIA's Own Assessments than Earlier Report - Senior CIA analyst Paul Pillar will later say that the agency’s own prewar assessments “foretold a long, difficult, and turbulent transition,” assessments more in line with the current NIE than with the 2002 estimate (see January 2003 and September 28, 2004). “It projected that a Marshall Plan-type effort would be required to restore the Iraqi economy, despite Iraq’s abundant oil resources. It forecast that in a deeply divided Iraqi society, with Sunnis resentful over the loss of their dominant position and Shi’ites seeking power commensurate with their majority status, there was a significant chance that the groups would engage in violent conflict unless an occupying power prevented it. And it anticipated that a foreign occupying force would itself be the target of resentment and attacks—including by guerrilla warfare—unless it established security and put Iraq on the road to prosperity in the few weeks or months after the fall of Saddam” Hussein. Despite some press reports that Mahmood directly ordered money to be sent to hijacker Mohamed Atta, there is virtually no mention of Mahmood or Pakistan in the Inquiry report that Goss co-chaired. Will Lead 'Purge' - During his confirmation hearings Goss pledges that he will be a nonpartisan CIA director, but he will purge the CIA of all but “true believers” in Bush’s policies shortly after becoming director (see November-December 2004). [Knight Ridder, 10/25/2004] CIA analyst Valerie Plame Wilson will later write that Goss “arrive[s] at headquarters with the clear intention to houseclean, and from the beginning [is] seen more as a crusader and occupier than former colleague. White House officials had suspected that CIA officials had leaked information prior to the election about the intelligence surrounding the war in Iraq that put the agency in a better light. Thus, Goss’s orders from the administration [are] probably along the lines of ‘get control of it.’” She will write that while most at the CIA welcome the idea of reform as a means to rebuild the agency’s credibility, “Goss’s heavy-handedness [will be] bitterly resented.” Goss will fail to have any meaningful dealings with “senior agency managers,” will spend “little time with the heads of foreign intelligence services (all of whom the CIA relied on for cooperation with counterterrorism and counterproliferation matters),” will fail to sufficiently engage “in day-to-day activities,” and will fail to gain a grasp of “some of the details of operations.” [Wilson, 2007, pp. 211-212]

The conservative lobbying and advocacy group Citizens United (CU) releases a documentary intended as a refutation of the popular documentary, Fahrenheit 9/11 (see June 25, 2004), a film by liberal documentarian Michael Moore that savaged the Bush administration’s handling of the 9/11 attacks. The CU film is entitled Celsius 41.11—The Temperature at Which the Brain Begins to Die. CU spent six weeks making the film, and is releasing it in small venues around the nation after the Federal Election Commission (FEC) denied the organization permission to broadcast it on television (see September 8, 2004). (In August, the FEC dismissed a complaint against Moore over Fahrenheit 9/11 filed by CU—see August 6, 2004.) The slogan for the movie is “The Truth Behind the Lies of Fahrenheit 9/11!” The movie was written and produced by Lionel Chetwynd, who has written and produced a number of Hollywood feature films and documentaries. Chetwynd, a vocal conservative, produced the September 2003 “docudrama” 9/11: Time of Crisis, which portrayed President Bush as a near-action hero during and after the 9/11 attacks, and took significant liberties with the actual events (see September 7, 2003). Of this film, Chetwynd says: “We could have gone wall to wall with red meat on this, but we purposely didn’t. The cheap shots may be entertaining in Moore’s film, but we wanted to make the intellectual case and go beyond lecturing to the converted.” New York Times reporter John Tierney describes the movie as overtly intellectual, sometimes appearing more as a PowerPoint presentation than a film made to appeal to a wider audience. It features a point-by-point defense of Bush’s actions during the 9/11 attacks, and features “politicians, journalists, and scholars discoursing on the legality of the Florida recount in 2000, the Clinton administration’s record on fighting terrorism, and the theory of American exceptionalism.” There are a few “red meat” moments, Tierney notes, including the juxtaposition of the Twin Towers burning as Moore says in a voiceover, “There is no terrorist threat.” It also includes a few slaps against Democratic presidential candidate John Kerry (D-MA), mostly in the form of a country song where the singer Larry Gatlin sings, “John boy, please tell us which way the wind’s blowing,” a reference to the Bush campaign’s attempt to portray Kerry as a “flip-flopper” who goes back and forth in his views on various issues. The Georgetown premiere of the movie attracts some 300 viewers, almost all Republicans, according to Tierney. The audience, according to Tierney, views the film as more “thoughtful and accurate” than Moore’s film, and unlikely to make anywhere near the profits the earlier film garnered. Chetwynd says he resisted the temptation to launch an all-out assault on Kerry “the way that Moore did with Bush.” Filmgoer Jerome Corsi, who has written a bestselling book attacking Kerry’s Vietnam record, praises the film, as does Debra Burlingame, whose brother was the pilot of the airplane that was flown into the Pentagon on the morning of September 11, 2001 (see 8:51 a.m.-8:54 a.m. September 11, 2001). Burlingame, a founder of a group of 9/11 victim relatives that supports Bush, says: “Michael Moore actually used footage of the Pentagon in flames as a sight gag. It was really hard to sit there in the theater listening to people laugh at that scene knowing my brother was on that plane. I wish more people would see this film instead.” [New York Times, 9/30/2004] In October, the Washington Post’s Philip Kennicott will dismiss the film as “generat[ing] heat but no new light,” calling it “sad in a sad sort of way… dull, lazy, and inconsistent,” and suffused with an “unabashed idolatry of the Great Leader (in this case, George W. Bush)” in the same way that Nazi propagandist Leni Riefenstahl made her documentaries (he wonders, “Has the conservative worldview really been reduced to a slavish worship of authority?”). Kennicott will ask if the film is an attempt to refute Moore’s documentary or an “overlong attack ad on John Kerry,” and concludes that the film is little more than a combination of “dreadful political advertisements and dreadful political talk shows.” [Washington Post, 10/22/2004] TV Guide’s Maitland McDonagh will call the film a “shrill, repetitive screed” obviously released just in time to influence the 2004 presidential election, and bearing “all the hallmarks of having been thrown together in a heated rush.” [TV Guide, 10/2004]

[Source: Associated Press]CBS News president Andrew Heyward refuses to air a scheduled segment of 60 Minutes II that probes the allegations of the Bush administration deliberately using forged documents to bolster its claim that Iraq attempted to purchase uranium from Niger (see Mid-January 2003 and 9:01 pm January 28, 2003)). In a statement, the network says it would be “inappropriate to air the report so close to the presidential election.” The network also decides not to run the piece because it has admitted to using questionable documents in a recent segment showing that President Bush received preferential treatment in joining the Texas Air National Guard during the height of the Vietnam War, and shirked his Guard duties thereafter without consequence. CBS had a team of correspondents and consulting reporters working for six months on the segment, and landed the first-ever on-camera interview with Italian journalist Elisabetta Burba, the first reporter to see the forged documents that formed the basis of the uranium allegations. (The CBS reporters also interviewed Burba’s source, information peddler Rocco Martino, but chose not to air any of that footage, and do not disclose Martino’s identity in the piece. Neither does the segment explore why the FBI has so far been reluctant to interview Martino in its investigation of the fraudulent uranium allegations.) The segment is later described by Newsweek journalists Michael Isikoff and Mark Hosenball as a hard-hitting investigative piece that “ask[s] tough questions about how the White House came to embrace the fraudulent documents and why administration officials chose to include a 16-word reference to the questionable uranium purchase in President Bush’s 2003 State of the Union speech” (see Mid-January 2003 and 9:01 pm January 28, 2003), and by Salon reporter Mary Jacoby as “making a powerful case that in trying to build support for the Iraq war, the Bush administration either knowingly deceived the American people about Saddam Hussein’s nuclear capabilities or was grossly credulous.… The report contains little new information, but it is powerfully, coherently, and credibly reported.” One of the central aspects of the segment is anchor Ed Bradley’s interview with Dr. Jafar Dhia Jafar, the former chief of Iraq’s nuclear program. Jafar confirms to Bradley that Iraq had dismantled its nuclear program after the Gulf War in the face of United Nations inspections. “So what was going on?” Bradley asks. “Nothing was going on,” Jafar replies. He says the Bush administration was either “being fed with the wrong information” or “they were doing this deliberately.” Another powerful moment is a clip from a German interview with the former foreign minister of Niger, Allele Habibou, whose signature appears on one of the forged documents. The document was dated 2000, but Habibou had been out of the government for 11 years by that point. “I only found out about this when my grandchildren found this on the Internet. I was shocked,” he says. The story is twice as long as the usual 15-minute segments broadcast on the show. Bradley, who narrates the report, is reportedly furious at the decision not to broadcast the segment. Jacoby concludes, ”60 Minutes defied the White House to produce this report. But it could not survive the network’s cowardice—cowardice born of self-inflicted wounds.” [Newsweek, 9/23/2004; Salon, 9/29/2004] The story will finally run on 60 Minutes almost two years later (see April 23, 2006).

In the 2004 presidential campaign, Democratic challenger Sen. John Kerry accuses the Bush administration of allowing bin Laden to escape Afghanistan in late 2001 by not sending enough US troops to contain him when he was trapped in the Tora Bora region. The New York Times publishes an op-ed by Gen. Tommy Franks, the former head of US Central Command. Franks writes, “On more than one occasion, Senator Kerry has referred to the fight at Tora Bora in Afghanistan during late 2001 as a missed opportunity for America. He claims that our forces had Osama bin Laden cornered and allowed him to escape. How did it happen? According to Mr. Kerry, we ‘outsourced’ the job to Afghan warlords. As commander of the allied forces in the Middle East, I was responsible for the operation at Tora Bora, and I can tell you that the senator’s understanding of events doesn’t square with reality.… We don’t know to this day whether Mr. bin Laden was at Tora Bora in December 2001. Some intelligence sources said he was; others indicated he was in Pakistan at the time; still others suggested he was in Kashmir. Tora Bora was teeming with Taliban and al-Qaeda operatives, many of whom were killed or captured, but Mr. bin Laden was never within our grasp.” Franks is a vocal supporter of Bush’s reelection. [New York Times, 10/19/2004] Shortly after Franks’ comments, four Knight Ridder reporters who had been at Tora Bora during the battle revisit the issue. They discover that “Franks and other top officials ignored warnings from their own and allied military and intelligence officers that the combination of precision bombing, special operations forces, and Afghan forces that had driven the Taliban from northern Afghanistan might not work in the heartland of the country’s dominant Pashtun tribe.” [Knight Ridder, 10/30/2004] Author Peter Bergen asserts, “There is plenty of evidence that bin Laden was at Tora Bora, and no evidence indicating that he was anywhere else at the time.” Bergen cites after-action US intelligence reports and interviews with US counterterrorism officials that express confidence bin Laden was at Tora Bora. He notes that bin Laden discussed his presence at the Tora Bora battle in a audio message released in 2003. [PeterBergen (.com), 10/28/2004] In 2005, Gary Berntsen, who was in charge of an on-the-ground CIA team trying to find bin Laden (see September 26, 2001), will claim that he gave Franks definitive evidence that bin Laden was trapped in Tora Bora (see Late October-Early December 2001). [Financial Times, 1/3/2006] In 2006, former counterterrorism “tsar” Richard Clarke will comment, “Yes, we know [bin Laden] absolutely was there.… And yes, he did escape. And Gen. Franks and the president can deny it until the cows come home, but they made a mistake. They did let him go away.” [PBS Frontline, 6/20/2006] In late 2006, it will be reported that the CIA possesses a video showing bin Laden walking out of Afghanistan at the end of the Tora Bora battle. It has not been reported if the CIA was aware of this video in 2004 or not (see Mid-December 2001).

Knight Ridder Newspapers reports on a leaked CIA assessment that undercuts the White House claim of links between al-Qaeda and Saddam Hussein. The assessment, requested some months ago by Vice President Cheney, finds no evidence to show that Saddam’s regime ever harbored Abu Musab al-Zarqawi, an independent colleague of Osama bin Laden (see April 2002), and finds no evidence of any “collaborative relationship” between the former Iraqi regime and al-Qaeda (see October 2, 2002). In February 2003, Secretary of State Colin Powell told the United Nations Security Council that al-Zarqawi went to Baghdad for medical treatment and, while there, helped establish a terrorist base in Baghdad (see February 5, 2003). The assessment now shows that claim was incorrect. So was the administration’s claim that al-Zarqawi received safe haven from Hussein. Defense Secretary Donald Rumsfeld, who in September 2002 called the evidence of links between Hussein and al-Qaeda “bulletproof” (see September 26, 2002), now says, “To my knowledge, I have not seen any strong, hard evidence that links the two.” Rumsfeld continues, “I just read an intelligence report recently about one person [al-Zarqawi] who’s connected to al-Qaeda who was in and out of Iraq and there’s the most tortured description of why he might have had a relationship and why he might not have had a relationship.” In June 2003, President Bush called al-Zarqawi “the best evidence of connection” between Iraq and al-Qaeda; after the assessments are leaked, Bush insists that al-Zarqawi “was in and out of Baghdad,” apparently continuing to press the idea that Saddam and al-Qaeda were connected. Al-Zarqawi did spend a lot of time in Iraq, but almost always in the northern sections of Iraq where Saddam’s control did not reach. [Knight Ridder, 10/4/2004] The day after the Knight Ridder report, Vice President Cheney will say during a debate with vice-presidential opponent John Edwards (D-NC) that al-Zarqawi was based in Baghdad both before and after the March 2003 invasion, a claim that is demonstrably false (see October 5, 2004).

British Prime Minister Tony Blair formally admits that he was wrong to have claimed that Saddam Hussein could deploy weapons of mass destruction within 45 minutes of giving the order (see September 24, 2002 and September 24, 2002). Blair’s Foreign Secretary, Jack Straw, reveals that MI6, the British intelligence agency, has formally withdrawn the claim, as well as other intelligence concerning Iraq’s ability to produce biological weapons. The claim has been heavily refuted for well over a year (see Late May 2003 and August 16, 2003). Straw refuses to say that it was a mistake to overthrow the Saddam government, saying instead that “deciding to give Saddam Hussein the benefit of the doubt would have required a huge leap of faith.… I do not accept, even with hindsight, that we were wrong to act as we did.” He notes that other governments, most notably the US government, were also convinced that Saddam had an array of WMD which could have been quickly deployed against targets in the region. Conservative MP Gary Streeter says the Blair administration owes the nation a “full apology”: “Not an apology for the intelligence but an apology for the way that the intelligence was conveyed by the government to the country.” [Age (Melbourne), 10/14/2004] Liberal Democrat Party leader Charles Kennedy accuses Blair of “avoiding answering” questions about the absence of Iraqi WMD. Liberal Democrat deputy leader Menzies Campbell says: “The withdrawal of the 45-minute claim drives a horse and cart through government credibility.… The building blocks of the government’s case for military action are crumbling before our eyes.” [Belfast Telegraph, 10/13/2004]

Deputy White House chief of staff Karl Rove, President Bush’s top political adviser, testifies for a third time before the grand jury investigating the Valerie Plame Wilson identity leak (see December 30, 2003). (The date of Rove’s second testimony to the grand jury is not publicly known, though Newsweek’s Michael Isikoff later says Rove testified twice in February 2004.) Rove tells the jury that he spoke with Time magazine reporter Matthew Cooper (see 11:00 a.m. July 11, 2003), a conversation he has failed to disclose in previous testimony both before the jury and when interviewed by FBI agents (see October 8, 2003 and February 2004). Rove now says he recalls speaking with Cooper, but cannot remember details of their conversation. His lawyer, Robert Luskin, says Rove “answered fully and truthfully every one of their questions,” and did not try to avoid answering questions on legal grounds. White House press secretary Scott McClellan says that Rove’s testimony shows he is “doing his part to cooperate” in the probe. Terry McAuliffe, the chairman of the Democratic National Committee, charges that Rove and other Bush aides are refusing to tell the public everything they know about the outing of Plame Wilson as a CIA official. “Karl Rove needs to come clean and tell us what he told the grand jury today,” McAuliffe says. Names Libby - Rove informs the jury that he may have learned of Plame Wilson’s identity from former White House official Lewis Libby, the chief of staff to Vice President Dick Cheney. Almost a year later, the Washington Post will learn of Rove’s naming of Libby from “a source familiar with Rove’s account.” Days before Plame Wilson’s identity was publicly revealed (see July 14, 2003), Libby and Rove discussed conversations they had had with Cooper and other, unnamed reporters. Both Plame Wilson’s CIA identity and her husband, war critic Joseph Wilson, were discussed, Rove tells the jury. He says that his conversations with Libby were confined to information the two men heard from reporters. He also says he heard about Plame Wilson’s CIA identity from “someone outside the White House,” but cannot recall that person’s identity. [Washington Post, 10/20/2005]
Claim of Memory Failure - Rove has claimed not to remember the conversation between himself and Cooper, but has recently found an e-mail he sent to Deputy National Security Adviser Stephen Hadley confirming the conversation (see After 11:07 a.m. July 11, 2003). Rove and Luskin claim that Rove only recently found the e-mail and immediately turned it over to Fitzgerald’s investigators. They claim that Rove never intended to withhold evidence from the investigation. [New York Times, 11/4/2005]
Kerry Campaign Calls for Full Disclosure from White House - Joe Lockhart, the campaign spokesman for the presidential campaign of John Kerry (D-MA), says: “With two weeks to go before the election, the American people are still in the dark about how it is that their White House leaked the name of an undercover CIA operative to the press, jeopardizing the life of this agent and possibly violating federal law. Instead of hiding behind the lawyers he so often likes to criticize, George Bush should direct Karl Rove and anyone else involved to go to the White House briefing room and come clean about their role in this insidious act.” [Salon, 10/15/2004]

Islamist militant leader Abu Musab al-Zarqawi and his group al-Tawhid pledges loyalty to bin Laden in a statement posted on the Internet. He states, [Let it be known that] al-Tawhid pledges both its leaders and its soldiers to the mujahid commander, Sheikh Osama bin Laden…” [Bergen, 2006, pp. 364] Bin Laden and al-Zarqawi began discussing the possibility of an alliance in early 2004 (see Early 2004). There had been other occasional contacts and linkages between al-Zarqawi and his group in years past, but al-Zarqawi had generally maintained his independence from al-Qaeda. Just one month earlier, al-Zarqawi stated, “I have not sworn allegiance to [bin Laden] and I am not working within the framework of his organization.” [Newsweek, 4/4/2005] The Atlantic Monthly will later report that at the same time al-Zarqwai made his loyalty oath, he also “proclaimed himself to be the ‘Emir of al-Qaeda’s Operations in the Land of Mesopotamia,’ a title that subordinated him to bin Laden but at the same time placed him firmly on the global stage. One explanation for this coming together of these two former antagonists was simple: al-Zarqawi profited from the al-Qaeda franchise, and bin Laden needed a presence in Iraq. Another explanation is more complex: bin Laden laid claim to al-Zarqawi in the hopes of forestalling his emergence as the single most important terrorist figure in the world, and al-Zarqawi accepted bin Laden’s endorsement to augment his credibility and to strengthen his grip on the Iraqi tribes. Both explanations are true. It was a pragmatic alliance, but tenuous from the start.” [Atlantic Monthly, 6/8/2006] In December 2004, an audiotape said to be the voice of bin Laden acknowledges al-Zarqawi’s comments. “It should be known that the mujahid brother Abu Musab al-Zarqawi is the emir of the al-Qaeda organization in [Iraq]. The brothers in the group there should heed his orders and obey him in all that which is good.” [Bergen, 2006, pp. 364-365]

Columnist and media observer Allan Wolper notes that while conservative columnist Robert Novak, who outed CIA agent Valerie Plame Wilson apparently at the behest of the White House (see July 14, 2003), continues to “spout… off in his syndicated column, he keeps a secret he would not permit any politician to get away with.” Wolper is writing of Novak’s continued refusal to divulge whether he was subpoenaed by the grand jury investigating the case, or if he testified before that grand jury. Wolper calls it an “untenable ethical position,” and bolsters his position with observations from media ethicists such as Robert Steele, the director of ethics for the Poynter Institute of Media Studies. “If he has a justifiable reason to withhold that information, he should give a reason why,” Steele says. “Otherwise, he is undermining his credibility as an honest broker of ethical journalism. If he were on the other side, he would challenge journalists for not saying anything.” Novak is defended by, among others, Washington Post reporter and assistant managing editor Bob Woodward, who says: “Bob Novak has taken a stand that is supported by many in the press. He is protecting his sources. He has done nothing that is illegal or improper.” (Wolper is unaware as of this writing that Woodward has his own secondary involvement in the case, having been himself told of Plame Wilson’s identity several times before (see June 13, 2003, June 23, 2003, and June 27, 2003).) Wolper notes that while Novak has refused to speak about subpoenas or testimonies, Post reporters Glenn Kessler and Walter Pincus have both given sworn depositions to the grand jury (see June 22, 2004 and September 15, 2004). Wolper writes, “They might have been able to fight off their subpoenas if their lawyers had known whether Novak… had been called by the grand jury.” Aside from Kessler and Pincus, Time reporter Matthew Cooper (see July 17, 2003) testified after being threatened with jail (see May 21, 2004, August 24, 2004, July 6, 2005, and July 13, 2005), and New York Times reporter Judith Miller is facing jail rather than testify (see December 2004). “Novak has an obligation to own up,” Wolper writes. Instead, “Novak continues to live a charmed life in journalism, writing his column and appearing regularly on CNN, where he is never challenged.” CNN media critic Jeff Greenfield says of Novak’s case, “I haven’t thought it through. I don’t want to talk about it, because I have no opinion on it.” Jack Nelson, the retired bureau chief of the Los Angeles Times, says: “This whole thing is really strange. Novak was the guy who wrote the column that exposed the CIA agent, and yet they don’t seem to be going after him.” [Editor & Publisher, 12/1/2004]

The Medal of Freedom is the highest honor the president can bestow. Bush comments, “This honor goes to three men who have played pivotal roles in great events and whose efforts have made our country more secure and advanced the cause of human liberty.” [Associated Press, 12/14/2001; Washington Post, 12/14/2004] However, the awards will come in for some criticism, as Tenet, CIA director on 9/11, wrongly believed Iraq had weapons of mass destruction (see December 21, 2002), Bremer disbanded the Iraqi army (see May 23, 2003), and Franks, responsible for the invasions of Afghanistan and Iraq, failed to assign enough troops to the hunt for Osama bin Laden, thereby enabling him to escape (see Late October-Early December 2001). If so, why the rush to hand out medals to people who had helped organize what was now looking like a badly botched, ill-conceived war?” [McClellan, 2008, pp. 250-251] David Wade, a spokesman for Senator John Kerry (D-MA), says, “My hunch is that George Bush wasn’t using the same standard when honoring Tenet and Bremer that was applied to previous honorees.” Previous recipients include human rights advocate Mother Teresa, civil rights icon Rosa Parks, and Pope John Paul II. Senator Carl Levin (D-MI) says he “would have reached a different conclusion” on Tenet. “I don’t think [he] served the president or the nation well.” [Associated Press, 12/14/2001] Reporter Steve Coll will later comment: “I presume that for President Bush, it was a signal that he wasn’t making Tenet a scapegoat. It would be the natural thing to do, right? You’ve seen this episode of ‘I, Claudius.’ You know, you put the knife in one side and the medal on the other side, and that’s politics.” And author James Bamford will say: “Tenet [retired], and kept his mouth shut about all the things that went on, about what kind of influence [Vice President Dick] Cheney might have had. They still have a CIA, but all the power is now with his team over at the Pentagon. They’re gathering more power every day in terms of intelligence. The US sends teams of US-trained former Iranian exiles, sometimes accompanied by US Special Forces, from Iraq into southern and eastern Iran to search for underground nuclear installations. [New Yorker, 1/24/2005; United Press International, 1/26/2005; Guardian, 1/29/2005] In the north, Israeli-trained Kurds from northern Iraq, occasionally assisted by US forces, look for signs of nuclear activity as well. [United Press International, 1/26/2005] Both teams are tasked with planting remote detection devices, known as “sniffers,” which can sense radioactive emissions and other indicators of nuclear-enrichment programs while also helping US war planners establish targets. [New Yorker, 1/24/2005; United Press International, 1/26/2005] The former Iranian exiles operating in the south and east are members of Mujahedeen-e Khalq (MEK), a group that has been included in the State Department’s list of foreign terrorist organizations since 1997 (see 1997) and included in a government white paper (see September 12, 2002) that criticized Iraq for its support of the group. After the US invaded Iraq, members of MEK were “consolidated, detained, disarmed, and screened for any past terrorist acts” by the US (see July 2004) and designated as “protected persons.” (see July 21, 2004) Initially, the MEK operate from Camp Habib in Basra, but they later launch their incursions from the Baluchi region in Pakistan. [United Press International, 1/26/2005; Newsweek, 2/15/2005] They are assisted by information from Pakistani scientists and technicians who have knowledge of Iran’s nuclear program. [New Yorker, 1/24/2005] Pakistan apparently agreed to cooperate with the US in exchange for assurances that Pakistan would not have to turn over A. Q. Khan, the so-called “father of Pakistan’s nuclear bomb,” to the IAEA or to any other international authorities for questioning. Khan, who is “linked to a vast consortium of nuclear black-market activities,” could potentially be of great assistance to these agencies in their efforts to undermine nuclear weapons proliferation. [New Yorker, 1/24/2005] In addition to allowing Pakistan to keep Khan, the US looks the other way as Pakistan continues to buy parts for its nuclear-weapons arsenal in the black market, according to a former high-level Pakistani diplomat interviewed by Seymour Hersh [New Yorker, 1/24/2005] The United States’ use of MEK is criticized by Western diplomats and analysts who agree with many Iranians who consider the group to be traitors because they fought alongside Iraqi troops against Iran in the 1980s. The memo reports on Merritt’s conclusions and proposals in the aftermath of a Pentagon-sponsored trip to Iraq by a number of military analysts. The trip is part of the Pentagon’s propaganda operation, which uses retired military officers to go on broadcast news shows and promote the administration’s Iraq policies (see April 20, 2008 and Early 2002 and Beyond). The memo is in several sections:
'Background' - “One of the most interesting things coming from this trip to Iraq with the media analysts has been learning how their jobs have been undergoing a metamorphosis. There are several reasons behind the morph… with an all voluntary military, no one in the media has current military background. Additionally we have been doing a good job of keeping these guys informed so they have ready answers when the networks come calling.”
'Current Issues' - “The key issue here is that more and more, media analysts are having a greater impact on the television media network coverage of military issues. They have now become the go to guys not only for breaking stories, but they influence the views on issues. They also have a huge amount of influence on what stories the network decides to cover proactively with regard to the military…”
'Recommendation' - “1.) I recommend we develop a core group from within our media analyst list of those that we can count on to carry our water. They become part of a ‘hot list’ of those that we immediately make calls to or put on an email distro [distribution] list before we contact or respond to media on hot issues. We can also do more proactive engagement with this list and give them tips on what stories to focus on and give them heads up on issues as they are developing. By providing them with key and valuable information, they become the key go to guys for the networks and it begins to weed out the less reliably friendly analysts by the networks themselves…

Media ops and outreach can work on a plan to maximize use of the analysts and figure out a system by which we keep our most reliably friendly analysts plugged in on everything from crisis response to future plans. Response from Di Rita - Di Rita is impressed. He replies, “This is a thoughtful note… I think it makes a lot of sense to do as you suggest and I guess I thought we were already doing a lot of this in terms of quick contact, etc… We ought to be doing this, though, and we should not make the list too small…” In 2008, Salon commentator Glenn Greenwald will sum up the plan: “So the Pentagon would maintain a team of ‘military analysts’ who reliably ‘carry their water—yet who were presented as independent analysts by the television and cable networks. By feeding only those pro-government sources key information and giving them access—even before responding to the press—only those handpicked analysts would be valuable to the networks, and that, in turn, would ensure that only pro-government sources were heard from. Meanwhile, the ‘less reliably friendly’ ones—frozen out by the Pentagon—would be ‘weeded out’ by the networks (see May 10-11, 2007). The pro-government military analysts would do what they were told because the Pentagon was ‘their bread and butter.’ These Pentagon-controlled analysts were used by the networks not only to comment on military matters—and to do so almost always unchallenged—but also even to shape and mold the networks’ coverage choices.” [Salon, 5/10/2008]

In an op-ed piece published by the Washington Post, David Kay, formerly of the Iraq Survey Group, recommends five steps the US should follow in order to avoid making the same “mistake” it made in Iraq when it wrongly concluded that Iraq had an active illicit weapons program. Three of the points address the issue of politicized intelligence. He implies that the US should learn from the experience it had with the Iraqi National Congress (see 2001-2003), which supplied US intelligence with sources who made false statements about Iraq’s weapon program. “Dissidents and exiles have their own agenda—regime change—and that before being accepted as truth any ‘evidence’ they might supply concerning Iran’s nuclear program must be tested and confirmed by other sources,” he says. In his fourth point, Kay makes it clear that the motives of administration officials should also be considered. He says it is necessary to “understand that overheated rhetoric from policymakers and senior administration officials, unsupported by evidence that can stand international scrutiny, undermines the ability of the United States to halt Iran’s nuclear activities.” And recalling the CIA’s infamous 2002 National Intelligence Estimate (NIE) on Iraq (see October 1, 2002), he says that an NIE on Iran “should not be a rushed and cooked document used to justify the threat of military action” and “should not be led by a team that is trying to prove a case for its boss.” [Washington Post, 2/9/2005]

The appeals court rules that because Miller and Cooper may have witnessed a federal crime—the disclosure of Plame Wilson’s covert CIA identity by government officials (see June 23, 2003, 8:30 a.m. July 8, 2003, Late Afternoon, July 12, 2003, 2:24 p.m. July 12, 2003, and 11:00 a.m. July 11, 2003)—the First Amendment does not protect them from testifying to the possible crime. The court finds that a 1972 Supreme Court ruling, Branzburg v. Hayes, applies: in that case, a reporter was ordered to testify about witnessing the production of illegal drugs. Jordanian journalist Fuad Hussein publishes a book that extensively quotes Saif al-Adel, who is believed to be al-Qaeda’s current military commander and possibly lives in Iran (see Spring 2002). Al-Adel claims: “Abu Musab [al-Zarqawi] and his Jordanian and Palestinian comrades opted to go to Iraq.… Our expectations of the situation indicated that the Americans would inevitably make a mistake and invade Iraq sooner or later. Such an invasion would aim at overthrowing the regime. Therefore, we should play an important role in the confrontation and resistance. Contrary to what the Americans frequently reiterated, al-Qaeda did not have any relationship with Saddam Hussein or his regime. We had to draw up a plan to enter Iraq through the north that was not under the control of [Hussein’s] regime. We would then spread south to the areas of our fraternal Sunni brothers. The fraternal brothers of the Ansar al-Islam expressed their willingness to offer assistance to help us achieve this goal.” [Bergen, 2006, pp. 120, 361-362] He says “the ultimate objective was to prompt” the US “to come out of its hole” and take direct military action in an Islamic country. “What we had wished for actually happened. Outgoing Undersecretary of Defense Douglas Feith, one of the key architects of the Iraq occupation, is bemused by the fact that, despite his predictions and those of his neoconservative colleagues, Iraq is teetering on the edge of all-out civil war. He has come under fire from both political enemies and former supporters, with Senator Carl Levin (D-MI) accusing him of deceiving both the White House and Congress, and fellow neoconservative William Kristol accusing him of “being an agent of” disgraced Defense Secretary Donald Rumsfeld (see November 6-December 18, 2006). Feith defends the invasion of Iraq, calling it “an operation to prevent the next, as it were, 9/11,” and noting that the failure to find WMD is essentially irrelevant to the justification for the war. “There’s a certain revisionism in people looking back and identifying the main intelligence error [the assumption of stockpiles] and then saying that our entire policy was built on that error.” Feith is apparently ignoring the fact that the administration’s arguments for invading Iraq—including many of his own assertions—were built almost entirely on the “error” of the Iraqi WMD threat (see July 30, 2001, Summer 2001, September 11, 2001-March 17, 2003, Shortly After September 11, 2001, September 14, 2001, September 19-20, 2001, September 20, 2001, October 14, 2001, November 14, 2001, 2002, 2002-March 2003, February 2002, Summer 2002, August 26, 2002, September 3, 2002, September 4, 2002, September 8, 2002, September 8, 2002, September 10, 2002, September 12, 2002, Late September 2002, September 19, 2002, September 24, 2002, September 24, 2002, September 28, 2002, October 7, 2002, December 3, 2002, December 12, 2002, January 9, 2003, February 3, 2003, February 5, 2003, February 8, 2003, March 22, 2003, and March 23, 2003, among others).
Cultural Understanding Did Not Lead to Success - Feith says he is not sure why what he describes as his deep understanding of Iraqi culture did not lead to accurate predictions of the welcome the US would receive from the Iraqi people (see November 18-19, 2001, 2002-2003, September 9, 2002, and October 11, 2002). “There’s a paradox I’ve never been able to work out,” he says. “It helps to be deeply knowledgeable about an area—to know the people, to know the language, to know the history, the culture, the literature. But it is not a guarantee that you will have the right strategy or policy as a matter of statecraft for dealing with that area. You see, the great experts in certain areas sometimes get it fundamentally wrong.” Who got it right? President Bush, he says. “[E]xpertise is a very good thing, but it is not the same thing as sound judgment regarding strategy and policy. George W. Bush has more insight, because of his knowledge of human beings and his sense of history, about the motive force, the craving for freedom and participation in self-rule, than do many of the language experts and history experts and culture experts.”
'Flowers in Their Minds' - When a reporter notes that Iraqis had not, as promised, greeted American soldiers with flowers, Feith responds that they were still too intimidated by their fear of the overthrown Hussein regime to physically express their gratitude. “But,” he says, “they had flowers in their minds.” [New Yorker, 5/9/2005; Scoblic, 2008, pp. 228-229]

Human rights advocacy group Amnesty International reports that both the US and Britain are betraying the cause of human rights in their “war on terror.” Amnesty’s general secretary, Irene Khan, accuses both governments of condoning torture and twisting their interpretations of the law to justify and excuse torture. She says: “A new agenda is in the making, with the language of freedom and justice being used to pursue policies of fear and insecurity. This includes cynical attempts to redefine and sanitize torture.” The US’s most well-known detention facility, Guantanamo Bay, is “the gulag of our time,” she says. “The US administration attempted to dilute the absolute ban on torture through new policies and quasi-management speak such as ‘environmental manipulation,’ ‘stress positions,’ and ‘sensory manipulation,’” she says. And when these two countries justify torture, other countries follow suit. “When the most powerful country in the world thumbs its nose at the rule of law and human rights, it grants a license to others to commit abuse with impunity. From Israel to Uzbekistan, Egypt to Nepal, governments have openly defied human rights and international humanitarian law in the name of national security and ‘counter-terrorism.’” [Guardian, 5/26/2005]

The Army suppresses an unclassified report by the RAND Corporation, a federally financed think tank that often does research for the military. The report, entitled “Rebuilding Iraq,” was compiled over 18 months; RAND submitted a classified and an unclassified version, hoping that the dissemination of the second version would spark public debate. However, senior Army officials are disturbed by the report’s broad criticisms of the White House, the Defense Department, and other government agencies, and the Army refuses to allow its publication. A Pentagon official says that the biggest reason for the suppression of the report is the fear of a potential conflict with Defense Secretary Donald Rumsfeld. The unclassified version of the report will be leaked to the New York Times in February 2008. That version finds problems with almost every organization and agency that played a part in planning for the Iraq invasion.
Bush, Rice Let Interdepartmental Squabbles Fester - The report faults President Bush, and by implication his former National Security Adviser Condoleezza Rice, for failing to resolve differences between rival agencies, particularly between the departments of Defense and State. “Throughout the planning process, tensions between the Defense Department and the State Department were never mediated by the president or his staff,” the report finds.
Defense Department Unqualified to Lead Reconstruction Effort - The report is also critical of the Defense Department’s being chosen to lead postwar reconstruction, citing that department’s “lack of capacity for civilian reconstruction planning and execution.” The Bush administration erred in assuming that reconstruction costs would be minimal, and in refusing to countenance differing views, the report says. Complementing that problem was the failure “to develop a single national plan that integrated humanitarian assistance, reconstruction, governance, infrastructure development and postwar security.” As a result, the report finds, “the US government did not provide strategic policy guidance for postwar Iraq until shortly before major combat operations commenced.”
State's Own Planning 'Uneven' and Not 'Actionable' - It questions the “Future of Iraq” study (see April 2002-March 2003), crediting it with identifying important issues, but calling it of “uneven quality” and saying it “did not constitute an actionable plan.”
Franks, Rumsfeld Exacerbated Problems - General Tommy Franks, who oversaw the entire military operation in Iraq, suffered from a “fundamental misunderstanding” of what the military needed to do to secure postwar Iraq, the study finds. Franks and his boss, Rumsfeld, exacerbated the situation by refusing to send adequate numbers or types of troops into Iraq after the fall of Baghdad.
Strengthened Resistance to US Occupation - The poor planning, lack of organization, and interdepartmental dissension together worked to strengthen the Iraqi insurgency. As Iraqi civilians continued to suffer from lack of security and essential services, resentment increased against the “negative effects of the US security presence,” and the US failed to seal Iraq’s borders, foreign and domestic support for the insurgents began to grow.
RAND Study Went Too Far Afield, Says Army - In 2008, after the Times receives the unclassified version of the report, Army spokesman Timothy Muchmore explains that the Army rejected the report because it went much farther than it should in examining issues pertinent to the Army. “After carefully reviewing the findings and recommendations of the thorough RAND assessment, the Army determined that the analysts had in some cases taken a broader perspective on the early planning and operational phases of Operation Iraqi Freedom than desired or chartered by the Army,” Muchmore will say. “Some of the RAND findings and recommendations were determined to be outside the purview of the Army and therefore of limited value in informing Army policies, programs and priorities.”
Recommendations - The Army needs to rethink its planning towards future wars, the report finds. Most importantly, it needs to consider the postwar needs of a region as much as it considers the strategy and tactics needed to win a war. [New York Times, 2/11/2008]

In his new book, “Countdown to Terror,” Congressman Curt Weldon (R-PA), the vice chairman of the House Homeland Security and Armed Services Committees, accuses the CIA of dismissing an informant who he says has valuable information on Iran. Weldon’s source claims to have knowledge that Osama Bin Laden is in Iran and that Iran’s supreme leader, Ayatollah Ali Khamenei, ordered a terrorist assault on the US called the “12th Imam attack.” But according to Bill Murray, a former CIA Station Chief in Paris who met with Weldon’s source on four occasions, the information provided by the informant was believed to have originated with Iranian gunrunner Manucher Ghorbanifar, a “known fabricator,” familiar to the CIA since the 1980s (see December 9, 2001 and December 2003). Murray compares Ghorbanifar to Ahmed Chalabi, whose false claims about Iraqi WMD were fed to US intelligence, Congress, and the public during the lead-up to war with Iraq. [American Prospect, 4/1/2005; New York Times, 6/8/2005] Murray later identifies Weldon’s source, whom Weldon nicknames “Ali,” as Ghorbanifar’s associate Fereidoun Mahdavi. According to Murray, Mahdavi is a complete liar. “Mahdavi works for Ghorbanifar,” Murray will say. “The two are inseparable. [Source: The Intelligence Summit]Three days before a group of military analysts are taken to Guantanamo by the Pentagon for an orchestrated “tour” (see June 24-25, 2005), one planning e-mail from Pentagon official Dallas Lawrence gives weight to the belief that the tour was arranged to prepare the analysts to deliver scripted talking points before the cameras (see April 20, 2008 and Early 2002 and Beyond). Lawrence notes the importance of scheduling the Guantanamo trip to ensure that an analyst for the American Spectator, Jed Babbin, can participate: “He is hosting a number of radio shows this summer. I would have to think he would have every member of Congress on to talk about their trip together—a definite plus for us looking to expand the echo chamber.” Babbin will respond with a Spectator article lambasting Democratic critics of Guantanamo, and will be given an invitation to appear on Bill O’Reilly’s Fox News talk show. Pentagon public relations official Lawrence Di Rita is quite pleased by Babbin’s work, and in an e-mail to other Pentagon officials, says: “We really should try to help [Babbin]. CNN analyst Donald Shepperd.CNN analyst Donald Shepperd. [Source: New York Times]With criticism of the Guantanamo Bay detention facility reaching new heights, new allegations of abuse from UN human rights experts, Amnesty International receiving plenty of media exposure for calling the facility “the gulag of our times” (see May 25, 2005), and many calling for the facility’s immediate closure, the Pentagon counters by launching the latest in its propaganda counteroffensive designed to offset and blunt such criticism (see April 20, 2008). The Pentagon and White House’s communications experts place a select group of around ten retired military officers, all who regularly appear on network and cable news broadcasts as “independent military analysts,” on a jet usually used by Vice President Dick Cheney, and fly them to Cuba for a carefully orchestrated tour of the facility. [New York Times, 4/20/2008]
A Four-Hour Tour - During the three-hour flight from Andrews Air Force Base to Cuba, the analysts are given several briefings by various Pentagon officials. After landing, but before being taken to the detention facility, they are given another 90-minute briefing. The analysts spend 50 minutes lunching with some of the soldiers on base, then begin their tour. They spend less than 90 minutes viewing the main part of the Guantanamo facility, Camp Delta; in that time, they watch an interrogation, look at an unoccupied cellblock, and visit the camp hospital. They spend ten minutes at Camp V and 35 minutes at Camp X-Ray. After less than four hours in Guantanamo’s detention facilities, they depart for Washington, DC. [Salon, 5/9/2008] This is the first of six such excursions, all designed to prepare the analysts for defending the administration’s point of view and counter the perception that Guantanamo is a haven for abusive treatment of prisoners. During the flight to the facility, during the tour, and during the return flight, Pentagon officials hammer home the message they want the analysts to spread: how much money has been spent on improving the facility, how much abuse the guards have endured, and the extensive rights and privileges granted to the detainees.
Producing Results - The analysts provide the desired results. All ten immediately appear on television and radio broadcasts, denouncing Amnesty International, challenging calls to close the facility, and assuring listeners that the detainees are being treated humanely. Donald Shepperd, a retired Air Force general, tells CNN just hours after returning from Guantanamo, “The impressions that you’re getting from the media and from the various pronouncements being made by people who have not been here in my opinion are totally false.” The next morning, retired Army General Montgomery Meigs appears on NBC’s flagship morning show, Today, and says: “There’s been over $100 million of new construction [at Guantanamo]. The place is very professionally run.” Transcripts of the analysts’ appearances are quickly circulated among senior White House and Pentagon officials, and cited as evidence that the Bush administration is winning the battle for public opinion. Retired Air Force General Donald Shepperd, a CNN news analyst, returns from a “fact-finding” trip to Guantanamo Bay (see June 24-25, 2005) prepared to provide Pentagon talking points to CNN audiences. Shepperd is remarkably candid about his willingness to serve as a Pentagon propagandist, writing in a “trip report” he files with his handlers, “Did we drink the ‘Government Kool-Aid?’—of course, and that was the purpose of the trip.” He acknowledges that “a one day visit does not an expert make” (Shepperd and his fellow analysts spent less than four hours touring the entire facility, all in the company of Pentagon officials), and notes that “the government was obviously going to put its best foot forward to get out its message.” He adds that “former military visitors are more likely to agree with government views than a more appropriately skeptical press.” Shepperd also sends an e-mail to Pentagon officials praising the trip and asking them to “let me know if I can help you.” He signs the e-mail, “Don Shepperd (CNN military analyst).” Shepperd’s e-mail is forwarded to Larry Di Rita, a top public relations aide to Secretary of Defense Donald Rumsfeld. Di Rita’s reply shows just how much control the Pentagon wields over the analysts. Di Rita replies, “OK, but let’s get him briefed on al-Khatani so he doesn’t go too far on that one.” Di Rita is referring to detainee Mohammed al-Khatani (see August 8, 2002-January 15, 2003), who had been subjected to particularly brutal treatment. Shepperd will, as planned, praise the Guantanamo detainee program on CNN in the days and hours following his visit to the facility (see June 24-25, 2005). Cucullu has just returned from a half-day tour of the Guantanamo detention facility (see June 24-25, 2005), and is prepared to give the Pentagon’s approved message to the media.
Talking Points Covered in Fox Appearance - In an e-mail to Pentagon official Dallas Lawrence, he alerts the department to a new article he has written for conservative Website FrontPage, and notes that he has appeared on an early-morning broadcast on Fox News and delivered the appropriate talking points: “I did a Fox & Friends hit at 0620 this morning. Good emphasis on 1) no torture, 2) detainees abuse guards, and 3) continuing source of vital intel.” [Salon, 5/9/2008]
Op-Ed: Pampered Detainees Regularly Abuse Guards - In the op-ed for FrontPage, entitled “What I Saw at Gitmo,” he writes that the US is being “extraordinarily lenient—far too lenient” on the detainees there. There is certainly abuse going on at Guantanamo, Cucullu writes—abuse of soldiers by the detainees. Based on his three-hour tour of the facility, which included viewing one “interrogation” and touring an unoccupied cellblock, Cucullu says that the detainees “fight their captors at every opportunity” and spew death threats against the soldiers, their families, and Americans in general. The soldiers are regularly splattered with “feces, urine, semen, and spit.” One detainee reportedly told another, “One day I will enjoy sucking American blood, although their blood is bitter, undrinkable.” US soldiers, whom Cucullu says uniformly treat the detainees with courtesy and restraint (see August 8, 2002-January 15, 2003), are constantly attacked by detainees who wield crudely made knives, or try to “gouge eyes and tear mouths [or] grab and break limbs as the guards pass them food.” In return, the detainees are given huge meals of “well-prepared food,” meals which typically overflow from two styrofoam containers. Many detainees insist on “special meal orders,” and throw fits if their meals are not made to order. The level of health care they are granted, Cucullu says, would suit even the most hypochondriac American. Cucullu writes that the detainees are lavished with ice cream treats, granted extended recreational periods, live in “plush environs,” and provided with a full array of religious paraphernalia. “They are not abused, hanged, tortured, beheaded, raped, mutilated, or in any way treated the way that they once treated their own captives—or now treat their guards.” The commander, Brigadier General Jay Hood, tells Cucullu that such pampered treatment provides better results than harsher measures. “Establishing rapport” is more effective than coercion, Hood says, and, in Cucullu’s words, Hood “refers skeptics to the massive amount of usable intelligence information [the detainees] produce even three years into the program.” In conclusion, Cucullu writes, the reader is “right to worry about inhumane treatment” at Guantanamo, but on behalf of the soldiers, not the detainees. According to CounterPunch, the Italian Parliament releases a report on the forged Iraq-Niger uranium documents (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003). The report names four people as the most likely forgers: neoconservative Michael Ledeen (see April 3, 2005), former CIA agent Duane Clarridge (see Late 1998), Iraqi National Congress (INC) head Ahmed Chalabi (see 1992-1996 and February 2002), and Chalabi’s close friend and colleague Francis Brooke, who belongs to the Rendon Group, a public relations group formed by the Pentagon in part to promote Chalabi and the INC (see May 1991 and Mid-December 2003). The report suggests the forgeries may have been planeed at a December 2001 meeting in Rome (see December 9, 2001) that involved Ledeen, head of the Italian intelligence service SISMI Nicolo Pollari (see September 9, 2002), and accused spy Larry Franklin (see December 9, 2001). [CounterPunch, 11/1/2005; CounterPunch, 11/9/2005] When the report is publicized in November 2005, Italian government officials will deny the existence of any such report, a denial bolstered by media reports. Journalist Laura Rozen will write that no such report was ever produced, nor was a parliamentary investigation into the Niger forgeries held by the Italian parliament at the time. “There is no parliamentary report,” a spokeswoman for Enzo Bianco, a member of Italy’s parliament, will say. Nor is there an unpublished report, the spokeswoman will say. Rozen will write that Bianco’s spokeswoman “does not just appear to be engaged in a cover up of a secret report. No one in Italy seriously investigating the Niger forgeries has heard of such a report.” The Italian newspaper La Repubblica will also report that no such parliamentary report was ever written. Former CIA officer Vincent Cannistraro, who will say he knew of rumors about such a report at one time, will also say that no such report exists. “There is no published report,” he will tell Rozen. “If there is a report, we might expect it would have some analysis and conclusions. Time reporter Matthew Cooper agrees to testify before the grand jury in the Valerie Plame Wilson identity leak investigation (see December 30, 2003 and July 13, 2005) after the source he has been protecting, White House political adviser Karl Rove, gives him a waiver dissolving their confidentiality agreement. Sources say that Cooper will identify Rove as a person who revealed Plame Wilson’s CIA identity to him. Cooper says he is prepared to remain “in civil contempt,” and ready to go to jail for defying the grand jury subpoenas, “because even though Time magazine had, over my objections, turned over my notes and e-mails to the special counsel under a court order, and even though the prosecutor has all that information now, I wanted—I was prepared to go and remain in civil contempt because I had given a word to my source for two years, which I have kept my word to that source today, for two years. This morning, in what can only be described as a stunning set of developments, that source agreed to give me a specific personal and unambiguous waiver to speak before the grand jury.” [New York Times, 7/7/2005] Cooper has not asked Rove for a waiver before, in part because his lawyer advised against it. Additionally, Time editors were worried about becoming part of such an explosive story in an election year. And Rove’s attorney, Robert Luskin, believed that contacting Cooper would have amounted to interfering with the ongoing court battle between reporter and prosecutor. [Los Angeles Times, 8/25/2005] Cooper adds, “It’s with a bit of surprise and no small amount of relief that I will comply with this subpoena.” Cooper refuses to publicly divulge the source he has been protecting, but a person briefed on the case confirms Cooper’s source as being Rove. [New York Times, 7/7/2005] Cooper did not speak to Rove directly on the issue. The waiver of confidentiality is the product of what the New York Times describes as “a frenzied series of phone calls” between Cooper’s lawyer Richard Sauber, Rove’s lawyer Luskin, and special prosecutor Patrick Fitzgerald. Cooper views his case as substantially different from that of his New York Times colleague, Judith Miller (see July 6, 2005). Miller has consistently refused to testify, but Cooper has already testified once, describing conversations he had with White House aide Lewis “Scooter” Libby (see August 24, 2004). And while the New York Times has consistently supported Miller, Time magazine has been more equivocal, turning over documents to Fitzgerald that identified Rove as Cooper’s source. Cooper’s friend Steven Waldman, a former US News and World Report editor who has talked with Cooper in recent days, says, “The question that was on his mind, and this is my words, is: do you go to jail to protect the confidentiality of a source whose name has been revealed, and not by you but by someone else?” Still, Cooper resisted until he saw an article in the Wall Street Journal that quoted Luskin as saying, “If Matt Cooper is going to jail to protect a source, it’s not Karl he’s protecting.” That statement prompted a round of telephone discussions between Luskin, Sauber, and Fitzgerald, culminating in Cooper’s decision to testify. “A short time ago,” Cooper tells the court, “in somewhat dramatic fashion, I received an express personal release from my source.” [New York Times, 7/10/2005]

Time reporter Matthew Cooper testifies before the grand jury investigating the Valerie Plame Wilson identity leak (see December 30, 2003 and July 1, 2005). [Washington Post, 7/3/2007] “I testified openly and honestly,” Cooper says after the session. “I have no idea whether a crime was committed or not. That is something the special counsel is going to have to determine.” [New York Times, 7/14/2005] Four days later, Cooper will write of his testimony for Time, though special prosecutor Patrick Fitzgerald told him he would rather Cooper remained silent. Cooper is under no legal obligation not to divulge his grand jury testimony. He will say that while grand juries are famously passive, ready to “indict a ham sandwich if a prosecutor asks it of them,” this one is unusually active. About a third of the questions he answers are from jurors, not prosecutors. Cooper testifies that in the week after Joseph Wilson’s now-famous op-ed disclosing the fraudulence of the Iraq-Niger uranium claims (see July 6, 2003), the administration had done something it rarely does: admit a mistake. It was admitting that it had erred in using that claim to advance its arguments for war with Iraq (see July 8, 2003). That was big news, and Cooper, having been at Time less than a month, was aggressively covering it. He was curious about the White House’s apparent efforts to smear Wilson, and called White House political adviser Karl Rove on July 11 to discuss the apparent smear campaign (see 11:00 a.m. July 11, 2003). The jury is interested, and apparently amused, at Cooper’s choice of words regarding the status of his conversation with Rove: “double super secret background.” Cooper concludes, “So did Rove leak Plame’s name to me, or tell me she was covert? No. Was it through my conversation with Rove that I learned for the first time that Wilson’s wife worked at the CIA and may have been responsible for sending him? Yes. Did Rove say that she worked at the ‘agency’ on ‘WMD’? Yes. When he said things would be declassified soon, was that itself impermissible? I don’t know. Is any of this a crime? Beats me. At this point, I’m as curious as anyone else to see what Patrick Fitzgerald has.” [Time, 7/17/2005]

A source from within the Valerie Plame Wilson identity leak investigation confirms that White House political adviser Karl Rove had spoken with conservative columnist Robert Novak before Novak published his column identifying Plame Wilson as a CIA officer (see July 8, 2003 and July 14, 2003). Rove discussed Plame Wilson with Novak. However, according to the source, Rove first heard about Plame Wilson from Novak, as well as learning from Novak that she had played a role in recommending her husband, Joseph Wilson, for a trip to Niger to investigate claims that Iraq had attempted to purchase uranium from that country (see February 21, 2002-March 4, 2002 and July 6, 2003). According to the source, Novak, not Rove, initiated the conversation about Plame Wilson. It is not clear who revealed Plame Wilson’s identity to Novak, or whether Novak has identified that source to the grand jury. [New York Times, 7/15/2005; New York Times, 7/16/2005] In its reporting, the New York Times publicly reveals the July 8, 2003 conversation between Rove and Novak (see July 8, 2003). Prosecutors in the Valerie Plame Wilson identity leak case (see December 30, 2003) become intensely interested in a 2003 State Department memo (see June 10, 2003) detailing how former ambassador Joseph Wilson—Plame Wilson’s husband—was chosen to journey to Niger to investigate claims that Iraq had attempted to purchase uranium from that country (see February 21, 2002-March 4, 2002). The memo also sheds light on the role Wilson’s wife played in his selection. Prosecutors are trying to learn whether White House officials learned of Plame Wilson’s identity from the memo, if any officials then leaked her name to the press, and if those officials were truthful in their testimony about the memo. It is possible that the memo could show that the State Department told the White House of Plame Wilson’s identity as an undercover CIA agent before July 6, 2003, when Wilson publicly lambasted the Bush administration’s justification for war with Iraq in a New York Times op-ed (see July 6, 2003). It is as yet unclear who actually saw the memo, or whether it was the original source of information for whoever gave Plame Wilson’s name to conservative columnist Robert Novak (see July 8, 2003). Former White House spokesman Ari Fleischer is also a person of interest in the investigation. Prosecutors want to know how much detailed information he had about the State Department memo. Former State Department official Marc Grossman, who has testified that he is one of the officials who divulged former CIA covert official Valerie Plame Wilson’s identity to former White House aide Lewis Libby (see 12:00 p.m. June 11, 2003), tells reporters that former ambassador Joseph Wilson’s trip to Niger (see March 4-5, 2002) had nothing to do with Plame Wilson being Wilson’s wife, as many of Libby’s defenders assert. Grossman wrote a memo detailing Wilson’s trip to Niger (see June 10, 2003) that was given to Libby and other White House officials. Grossman, speaking anonymously, says: “It wasn’t a Wilson-Wilson wife memo. It was a memo on uranium in Niger and focused principally on our [the State Department’s] disagreement” with the White House. The memo noted, erroneously, that Plame Wilson helped engineer Wilson’s trip to Niger (see February 19, 2002, July 22, 2003, and October 17, 2003), but Grossman says it did not identify her as an undercover CIA agent, nor did it identify her as Valerie Plame, which was her maiden name and cover name at the CIA. Grossman says the fact that the CIA official and Wilson were a married couple was largely an incidental reference. [Source: Boston Globe]Liberal blogger Arianna Huffington slams the perception that New York Times reporter Judith Miller is, in Huffington’s words, “a heroic martyr, sacrificing her freedom in the name of journalistic integrity” by going to jail to protect her White House sources in the Plame Wilson leak investigation (see July 6, 2005). Huffington speculates that Miller is herself the source she is trying to protect. It was Miller, Huffington theorizes, who found out from “her friends in the intelligence community” that Plame Wilson was a covert CIA agent, and subsequently told White House official Lewis Libby of Plame Wilson’s CIA status. Miller’s motivation was to protect her own rapidly deteriorating reputation as a purveyor of manipulated and deceptive information to promote the Iraq invasion (see July 6, 2003 and July 25, 2003). “Maybe Miller tells [White House official Karl] Rove too—or Libby does. The White House hatchet men turn around and tell [reporters Robert] Novak and [Matthew] Cooper. The story gets out. This is why Miller doesn’t want to reveal her ‘source’ at the White House—because she was the source.… This also explains why Miller never wrote a story about Plame, because her goal wasn’t to write a story, but to get out the story that cast doubts on Wilson’s motives. Which Novak did” (see July 14, 2003). [Huffington Post, 7/27/2005] When Miller learns of Huffington’s article, via her lawyer Saul Pilchen, she is horrified. Pilchen, himself taken aback by Huffington’s vociferous and unsourced assertions (which Huffington called “a scenario” and not established fact), will later tell reporter Marie Brennan: “It was my first experience with the blog culture. It was astounding to me how little constraint the bloggers had. They were passing off speculation as fact, and it read to me like pure character assassination.” Miller considers the Huffington piece certainly mistaken, and possibly libelous. But, as Brennan will later observe, the discussion and debate generated by Huffington and many others in the “blogosphere” make it difficult for fellow journalists to defend Miller. Representative Rush Holt (D-NJ) introduces a resolution that would request the Bush administration to divulge the name, or names, of the White House officials responsible for leaking the CIA status of Valerie Plame Wilson to the press (see June 13, 2003, June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, 8:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, 1:26 p.m. July 12, 2003, and July 12, 2003). The resolutions are referred to four House committees: Judiciary, International Relations, Armed Services, and Intelligence. The Republican leadership votes the resolution down in each committee, arguing in each case that to make such a request would interfere with the Justice Department’s ongoing criminal investigation. In December 2005, the Democrats on the House Judiciary Committee will write, “This argument would seem to be disingenuous given that there are numerous precedents for Congressional committees investigating concurrently with the Justice Department and with other matters under criminal review by the executive branch, most notably many concurrent investigations by the Republican Congress involving the Clinton administration.” [Waxman, 12/2005]

Washington Post editor and reporter Bob Woodward repeats the baseless claim that a 2002 report by former ambassador Joseph Wilson on attempts by Iraq to secure Nigerien uranium (see March 8, 2002) contradicted his 2003 New York Times op-ed criticizing the Bush administration’s use of the uranium claim to justify its invasion of Iraq (see July 6, 2003). The progressive media watchdog organization Media Matters will note that according to a Senate Intelligence Committee report (see July 9, 2004), “there appears to be no contradiction between the report and Wilson’s op-ed.… Wilson’s language [in the op-ed] closely echoes the Intelligence Committee’s description of his report.” Woodward says that according to Wilson’s 2002 report, “there were reasonable grounds to discredit” Wilson, and goes on to say that Wilson “had said something in his reports a year before that contradicted what he wrote in an op-ed piece in the New York Times.” Woodward also mocks the idea that anyone in the Bush administration wants to “trash” or “discredit” Wilson (see June 2003, June 3, 2003, June 11, 2003, June 12, 2003, June 19 or 20, 2003, July 6, 2003, July 6-10, 2003, July 7, 2003 or Shortly After, 8:45 a.m. July 7, 2003, 9:22 a.m. July 7, 2003, July 7-8, 2003, July 11, 2003, (July 11, 2003), July 12, 2003, July 12, 2003, July 18, 2003, October 1, 2003, and April 5, 2006), and goes on to say that “there were reasonable grounds to discredit him.” [Media Matters, 8/1/2005] Woodward does not reveal that he himself was an early recipient of the White House’s leaked information that Wilson’s wife is a clandestine CIA officer (see June 13, 2003).

Members of the special counsel’s investigation into the Plame Wilson identity leak learn that former White House official Lewis Libby and/or his attorney, Joseph Tate, may have tried to influence or discourage New York Times reporter Judith Miller’s testimony. Miller received information from Libby about Plame Wilson’s covert CIA status (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Special counsel Patrick Fitzgerald and his staff learn from press accounts of possible witness tampering by either Libby, Tate, or both. It is known that Tate has discouraged Libby from giving Miller a waiver of confidentiality that would free her from her responsibility of protecting Libby as a source. Miller is currently in jail for refusing to testify in the investigation (see July 6, 2005). Upon learning about the potential tampering, Fitzgerald strongly urges attorneys for Miller and Libby to negotiate an agreement that would allow Miller to testify. (Libby will give Miller a waiver releasing her from their confidentiality agreement—see September 15, 2005). According to investigative reporter Murray Waas, because Fitzgerald is loathe to lose Miller’s testimony, and is unsure of what she might testify to, he will not aggressively pursue the possibility that Libby and/or Tate might have attempted to influence or discourage Miller’s testimony (see August 12, 2004 and After). However, the possibility of witness tampering does give further impetus to Fitzgerald’s inclination to bring criminal charges against Libby. Waas will write, “Potentially misleading and incomplete answers by Libby to federal investigators are less likely to be explained away as the result of his faulty memory or inadvertent mistakes,” according to his sources. A Justice Department official will tell Waas: “Both intent and frame of mind are often essential to bringing the type of charges Fitzgerald is apparently considering. And not wanting a key witness to testify goes straight to showing that there were indeed bad intentions.” [National Journal, 10/18/2005]

The US intelligence community releases a National Intelligence Estimate (NIE) on Iran, the first of its kind since 2001. Its central conclusion is that Iran is about ten years away from manufacturing enough highly enriched uranium to make a nuclear weapon. That doubles the previous estimate of five years. (The “five years away” estimate has been a staple of US assertions about Iran’s nuclear program since 1995.) Even then, the report states, it is unclear whether Iran would have the technology capable of using the uranium in a functional nuclear device. The NIE gives little support for recent statements by Bush administration officials that assert Iran is working hard to develop and deploy a nuclear weapon, and that such deployment could happen much sooner than ten or even five years. President Bush has said repeatedly that while he wants to resolve the crisis with Iran diplomatically, “all options are on the table,” meaning a potential military strike is being considered. The NIE says that Iran is conducting clandestine work as part of its nuclear program, but there is no way to know if that work is on nuclear weapons development. Iran is, the report states, acquiring technologies that could be diverted to bomb-making. It is uncertain whether Iran’s ruling mullahs have decided whether to build a nuclear arsenal, the NIE says, but, according to a senior intelligence official, “it is the judgment of the intelligence community that, left to its own devices, Iran is determined to build nuclear weapons.” The White House has refrained from attributing its assertions about Iran’s nuclear program to US intelligence, as it did with Iraq before the March 2003 invasion. Instead, it has pointed to Iranian efforts to conceal its activities, and questioned why, since Iran has tremendous oil and natural gas reserves, it would need a nuclear energy program. The administration is riven with infighting and competing viewpoints on Iran’s nuclear program, and this NIE does little to resolve those differences. The NIE also says that the US intelligence community still knows far too little about Iran’s nuclear program. The intelligence community gathers most of its information from communication intercepts, satellite imagery, and reports from the UN inspectors who have been investigating Iran’s nuclear program since 2003. Those inspectors have found facilities for uranium conversion and enrichment, results of plutonium tests, and equipment bought illicitly from Pakistan, all of which raised serious concerns but could be explained by an energy program. Inspectors have found no evidence that Iran possesses a nuclear warhead design or is conducting a nuclear weapons program. Deputy Director of National Intelligence Michael Hayden says that since the October 2002 NIE, which wrongly concluded Iraq was reconstituting its nuclear program (see October 1, 2002), the rules governing the creation of NIEs have been revamped to mandate “a higher tolerance for ambiguity,” even if NIEs would be less conclusive in the process. [Washington Post, 8/2/2005] In 2007, a new NIE will conclude that Iran actually stopped work on a nuclear weapon in 2003 (see December 3, 2007).

Hours after their deaths, William Cowan, a retired Marine colonel and Fox News analyst (see April 20, 2008 and Early 2002 and Beyond) who has grown increasingly uncomfortable with what he will later call the Pentagon’s “twisted version of reality” being pushed on analysts in briefings, telephones the Pentagon to advise officials that his upcoming comments on Fox “may not all be friendly.” He is then given a private briefing, quickly arranged by Defense Secretary Donald Rumsfeld’s senior aides. But Cowan then tells Fox host Bill O’Reilly that it has been “a bad week” in Iraq, that many military officials he has talked to were “expressing a lot of dismay and disappointment at the way things are going,” and the US is “not on a good glide path right now” in Iraq. The repercussions are almost immediate. According to Cowan, he is “precipitously fired from the analysts group” for this appearance. The Pentagon “simply didn’t like the fact that I wasn’t carrying their water.” Cowan later recalls: “Suddenly, boom, I never got another telephone call, I never got another e-mail from them.… I was just booted off the group. I was fired.” Cowan will say that he and other analysts were given special access only “as long as they thought I was serving their purposes.… I drink nobody’s Kool-Aid.” The next day, the other analysts take part in a conference call with General James Conway, the director of operations for the Joint Chiefs of Staff, where he urges them not to let the Marines’ deaths erode support for the war. Conway is blunt, saying directly that the US citizenry is the main target of Pentagon propaganda. “The strategic target remains our population,” he tells them. “We can lose people day in and day out, but they’re never going to beat our military. What they can and will do if they can is strip away our support. And you guys can help us not let that happen.” An analyst chimes in, “General, I just made that point on the air.” Conway says, “Let’s work it together, guys.” [New York Times, 4/20/2008; Washington Post, 4/21/2008]

Two lobbyists for the American Israel Public Affairs Committee (AIPAC), Steven Rosen and Keith Weissman, are indicted for crimes relating to their role in passing classified US government information to Israel (see April 13, 1999-2004). They are charged with conspiring “to communicate national defense information [to] persons not entitled to receive it,” applicable under the Espionage Act. Their charges are similar to those filed against former government employee Larry Franklin, their contact (see October 5, 2005). National security expert Eli Lake will call the charges against Rosen and Weissman “unprecedented,” noting that for them to face the same charges as Franklin puts them—two private citizens—under the same obligation as Franklin, a government official, to keep secret any classified information they might acquire. Lake will write: “[I]f it’s illegal for Rosen and Weissman to seek and receive ‘classified information,’ then many investigative journalists are also criminals—not to mention former government officials who write for scholarly journals or the scores of men and women who petition the federal government on defense and foreign policy. In fact, the leaking of classified information is routine in Washington, where such data is traded as a kind of currency. And, while most administrations have tried to crack down on leaks, they have almost always shied away from going after those who receive them—until now. At a time when a growing amount of information is being classified, the prosecution of Rosen and Weissman threatens to have a chilling effect—not on the ability of foreign agents to influence US policy, but on the ability of the American public to understand it.” [US v. Bush has come to his ranch for his yearly August vacation; Sheehan has come to demand a meeting with Bush to discuss the loss of her son, Casey, in Iraq. Sheehan chooses the date to coincide with the fourth anniversary of the briefing that warned Bush of Osama bin Laden’s intention to attack the US (see August 6, 2001). Camp Casey begins as a single pup tent in a ditch by the side of a dirt road, in which Sheehan intends to stay for whatever time it takes to secure a meeting with Bush. Author and media critic Frank Rich later writes that because Bush is so firmly ensconsced in the protective “bubble” that shields him from awareness of criticism, he and his top officials are blindsided by the media response to Sheehan’s lonely vigil. Casey Sheehan, who died in April 2004 a mere two weeks after his arrival in Iraq (see April 4, 2004), will become, Rich will write, emblematic of both “the noble intentions of those who volunteered to fight the war [and] also the arrogance, incompetence, and recklessness of those who gave the marching orders.”
Bush Refuses to Meet with Sheehan - Bush will refuse to meet with Sheehan and the increasing number of peace activists who gather at Camp Casey, causing him inordinate embarrassment (see August 12, 2005) as more and more reporters begin questioning his motives in refusing to meet with the bereaved mother of a fallen US soldier. Bush even ignores the advice of some of his public relations staffers and fellow Republicans, who ask him to reconsider, as Senator George Allen (R-VA) says, “as a matter of courtesy and decency.” Rich will write: “Only someone as adrift as Bush would need to be told that a vacationing president couldn’t win a standoff with a grief-stricken parent commandeering TV cameras and the blogosphere 24/7. But the White House held firm. In a particularly unfortunate gesture, the presidential motorcade, in a rare foray out of the vacation compound, left Sheehan in the dust on its way to a fundraiser at a fat cat’s ranch nearby” (see August 12, 2005). [Rich, 2006, pp. 193-196] Political analyst Charlie Cook says: “Anything that focuses media and public attention on Iraq war casualties day after day—particularly [something] that is a good visual for television, like a weeping Gold Star mother—is a really bad thing for President Bush and his administration.… Americans get a little numb by the numbers of war casualties, but when faces, names, and families are added, it has a much greater effect.” Republican strategist Kellyanne Conway agrees, saying: “Cindy Sheehan has tapped into a latent but fervent feeling among some in this country who would prefer that we not engage our troops in Iraq. She can tap into what has been an astonishingly silent minority since the end of last year’s presidential contest. It will capture attention.” University professor Stephen Hess says that Sheehan’s “movement… can be countered by a countermovement” and therefore negated, but “I think the president might have defused the situation if he had invited her in instantly.” Hess predicts that Sheehan will soon be targeted by Republican strategists in a counterattack (see August 11, 2005 and After).
Focus of Antiwar Movement - Camp Casey quickly becomes the focus of the American antiwar movement, with organizations such as MoveOn.org and Code Pink pitching in to help expand and coordinate the camp, and high-profile Democratic operatives such as Joe Trippi organizing support among left-wing bloggers. MoveOn’s Tom Mattzie says: “Cindy reached out to us.… Cindy is a morally pure voice on the war, so we’re trying to keep the focus on her and not jump in and turn it into a political fight.” [Los Angeles Times, 8/11/2005]

Right-wing commentators react to the sudden media presence of antiwar activist and bereaved mother Cindy Sheehan (see August 6, 2005 and After) with vitriolic criticism. (Author and media critic Frank Rich will later write of his belief that the anti-Sheehan campaign is orchestrated from the White House: “The attack was especially vicious because there was little the White House feared more than a critic who had more battle scars than a president or a vice president who had avoided Vietnam.”) Weekly Standard writer Fred Barnes tells Fox News viewers that Sheehan is a “crackpot.” Right-wing bloggers begin spreading lurid, and sometimes false, stories of her recent divorce and the opposition Sheehan receives from some of her family members. Because some of the Camp Casey protesters showed the recent Iraq documentary Fahrenheit 9/11 (see June 25, 2004), many right-wing commentators and pundits accuse Sheehan of being a tool of documentary filmmaker Michael Moore. Conservative pundit Michelle Malkin accuses Sheehan and other bereaved family members opposing the war of using their losses to promote their ideological agenda, and calls them “grief pimps.” The American Spectator says Sheehan’s own peace organization, Gold Star Families for Peace, “seeks to impeach George W. Bush and apparently to convince the US government to surrender to Muslim terrorists.” Talk-show host Rush Limbaugh makes the extraordinary claim that Sheehan is making up the entire story of her son’s death (see April 4, 2004), claiming that her loss “is nothing more than forged documents—there’s nothing about it that’s real.” Rich later notes that what he calls “the Swift Boating of Cindy Sheehan” has “failed, utterly.” He will continue: “The hope this time was that we’d change the subject to Cindy Sheehan’s ‘wacko’ rhetoric and the opportunistic left-wing groups that have attached themselves to her like barnacles. That way we would forget about her dead son. Bush is on his way to a fundraising barbecue expected to raise at least $2 million for the Republican National Committee. Camp founder Cindy Sheehan holds a sign that reads, “Why do you make time for donors and not for me?” The Associated Press reports, “It was unclear whether Bush, riding in a black Suburban with tinted windows, saw the demonstrators.” Bush has continued to refuse to meet with Sheehan and the others in Camp Casey, a makeshift camp three miles outside of his Crawford, Texas vacation ranch. The camp is attracting war protesters, peace activists, and bereaved family members who have lost loved ones in Iraq and Afghanistan. [Associated Press, 8/12/2005] The New York Times notes that in less than a week, Camp Casey has grown from one woman’s lonely vigil to a gathering of well over 100 protesters and family members, with visits from celebrities such as actor Viggo Mortensen and a full-time police presence. War supporters have blasted Sheehan and her companions, calling her everything from a traitor to a terrorist supporter, and arguing that the death of her son does not give her the right to criticize the war effort. Local supporters of Bush have suggested, among other things, that they unleash a gaggle of skunks on the camp to drive the protesters away; some have pretended to drive their pickup trucks into the crowds, and splashed protesters with mud as they revved their engines. [New York Times, 8/13/2005] Author and media critic Frank Rich will later write that the images of Bush’s motorcade ignoring Sheehan and the other protesters become embarrassing fodder for media comment and criticism. [Rich, 2006, pp. 194] The Times writes, “[Bush’s] five-week sojourn at his 1,600-acre ranch offers the protesters ample opportunity to camp out for extended periods in front of the national media at a time of sharp spikes in the casualties in Iraq, and as public polling data suggests the lowest support for the war since it began.” In a recent television ad paid for by her peace organization Gold Star Families for Peace, Sheehan said: “All I wanted was an hour out of his extended vacation time, but he’s refused to meet with me and the other military families. Unlike Sheehan, Pruett and her family staunchly support the war; also unlike Sheehan, Pruett has not lost any of her sons. Apparently the White House found Pruett after learning of her family’s appearance on CNN in June 2004, where she defended the war effort, and contacted the family a week before the event. “An obviously delighted President Bush,” who has repeatedly refused to meet with Sheehan (see August 12, 2005), flies to Idaho to introduce Pruett to what the Washington Post calls “a boisterous invitation-only audience mostly made up of military families.” Bush tells the audience: “There are few things in life more difficult than seeing a loved one go off to war. And here in Idaho, a mom named Tammy Pruett—I think she’s here—knows that feeling six times over. Tammy has four sons serving in Iraq right now with the Idaho National Guard—Eric, Evan, Greg, and Jeff. Last year, her husband Leon and another son, Eren, returned from Iraq, where they helped train Iraqi firefighters in Mosul. Tammy says this—and I want you to hear this—‘I know that if something happens to one of the boys, they would leave this world doing what they believe, what they think is right for our country. And I guess you couldn’t ask for a better way of life than giving it for something that you believe in.’ America lives in freedom because of families like the Pruetts.” Bush kisses Pruett on the cheek after the speech, then sends her out to talk to the press. Pruetts Offer Condolences to Sheehan, Other Bereaved Families - But the Pruetts are not willing to merely serve as props for the White House’s pro-war agenda. Both Leon and Tammy Pruett are quick to offer tearful condolences to families who have lost loved ones overseas, specifically naming Sheehan. Tammy says while her family supports the war, they do not want to be seen as criticizing those who oppose it. “We don’t feel like we’re out here trying to be a poster family, we’re just proud of our sons,” she says. Careful Staging - The Post notes that the Pruett speech is viewed by White House planners “as a crucial opportunity for Bush to show both compassion and resolve when his conduct of the war is increasingly being publicly questioned, and polls of public support are flirting with Vietnam War-era depths.” The speech and presentation are carefully crafted, with a drum corps playing the themes of each of the five branches of service, and Bush placed before a group of soldiers dressed in fatigues and arrayed in front of a huge red, white, and blue backdrop festooned with photographs of soldiers, police officers, firefighters, and rescue workers beneath the heading “Honoring America’s Soldiers.” The entire event, Knight Ridder reporter William Douglas writes, is designed to “creat[e] a visual link between the Sept. 11, 2001, terrorist attacks and the war in Iraq.” [MSNBC, 8/24/2005; Washington Post, 8/25/2005]

Special counsel Patrick Fitzgerald writes a letter to Joseph Tate, one of the lawyers representing White House aide Lewis Libby. Fitzgerald wants to clarify any potential misunderstandings regarding Libby’s possible release of reporter Judith Miller from their understanding of confidentiality. Miller is currently serving an indefinite jail sentence over her refusal to testify before Fitzgerald’s grand jury about her conversations with Libby (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Fitzgerald cites media accounts that indicate there may be misunderstanding between the parties; he affirms that any communication from Libby to Miller granting Miller a confidentiality waiver would be voluntary, and would not be construed as obstruction. Lewis “Scooter” Libby, the chief of staff for Vice President Dick Cheney, writes jailed reporter Judith Miller (see July 6, 2005) a chatty two-page letter that asserts he had wanted her to testify about their conversations all along. Miller is jailed pending her reversal of a decision not to reveal Libby as a confidential source; Libby had told Miller that former ambassador Joseph Wilson’s wife Valerie Plame Wilson was a CIA agent (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Libby’s letter comes after rounds of intensive negotiations between his lawyers, Miller’s lawyer Robert Bennett, and special counsel Patrick Fitzgerald. Libby says that he is glad to grant Miller a waiver of confidentiality which will allow her to testify about their conversations (see September 12, 2005), and says that a year earlier his lawyer had assured her lawyer that he had then waived confidentiality (see January 2-5, 2004). He reassures her that his decision to waive confidentiality is completely voluntary, and says he will actually be “better off” if she testifies. In conclusion, Libby writes: “You went into jail in the summer. It is fall now. You will have stories to cover—Iraqi elections and suicide bombers, biological threats and the Iranian nuclear program. Out West, where you vacation, the aspens will be turning. They turn in clusters, because their roots connect them. Come back to work—and life.” [Libby, 9/15/2005 pdf file; New York Times, 9/29/2005] Miller will deny any hidden meaning in Libby’s last few lines, and deny to Fitzgerald that Libby attempted to “shape” her testimony in any way through the letter. [New York Times, 10/16/2005] Bennett will say he does not believe that Libby was trying to influence Miller’s testimony, but knew as soon as he read his letter that it would “be trouble” for her. “I know that the letter bothered [Judy] and it bothered me,” Bennett says. “She might be soon testifying, and a prosecutor might construe that as an attempt to influence her testimony. It was more probably just sort of a dumb thing to put in a letter.” Bennett will add: “I think it is important that Judy was protecting a source in terms of source confidentiality and the journalistic privilege. She was not protecting a source to prevent someone from going to jail. The letter just didn’t help matters.” [National Journal, 10/18/2005]

The Washington Post publishes an article, written by Susan Schmidt and Jim VanderHei, that reveals details of White House official Lewis Libby’s conversations with New York Times reporter Judith Miller (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Miller has just been released from jail (see September 29, 2005) after receiving a confidentiality waiver from Libby (see September 15, 2005). The details of the Libby-Miller conversations come from a source the reporters call “familiar with Libby’s account of his conversations with Miller in July 2003.” According to the source, Libby told Miller he heard that former ambassador Joseph Wilson’s wife, Valerie Plame Wilson, “had something to do with sending him” to Niger (see February 21, 2002-March 4, 2002), “but he did not know who she was or where she worked, the source said.” The reporters then write that during his second conversation with Miller, Libby said he had learned that Plame Wilson “had a role in sending him on the trip and that she worked for the CIA. Libby never knew Plame’s name or that she was a covert operative, the source said.” The source also told the reporters that Libby never spoke with columnist Robert Novak about Plame Wilson (see July 14, 2003). [Washington Post, 9/30/2009] The source “familiar with Libby’s” testimony was repeating the same falsehoods that Libby told the Plame Wilson grand jury (see March 5, 2004 and March 24, 2004). Miller will testify that in their first conversation, Libby told her that Wilson’s wife worked for the CIA’s Weapons, Intelligence, Non-Proliferation, and Arms Control office (see September 30, 2005, October 7, 2005, and October 12, 2005). [National Journal, 10/18/2005] Author and blogger Marcy Wheeler will later write that she believes Libby used the Post story to attempt to “coach” Miller’s testimony. Both Wheeler and reporter Murray Waas will note that the same anonymous source quoted in the Schmidt/VandeHei story attempted, and failed, to get articles based on the same information published in two other newspapers. Waas will write: “Journalists at two news organizations declined to publish stories. Among their concerns was that they had only a single source for the story and that that source had such a strong bias on behalf of Libby that the account of his grand jury testimony might possibly be incomplete or misleading in some way. But more important were concerns that a leak of an account of Libby’s grand jury testimony, on the eve of Miller’s own testimony, might be an effort—using the media—to let Miller know what Libby had said, if she wanted to give testimony beneficial to him, or similar to his. (There is no evidence that Miller did not testify truthfully to the grand jury.)” Wheeler accuses Schmidt of being Libby’s “stenographer,” a reporter all too willing to publish whatever a person wishes without investigating the possible motives behind the provision of the information. Wheeler also believes Libby may have attempted to coach or influence Miller’s testimony in his letter releasing the reporter from their confidentiality agreement (see September 15, 2005). [Washington Post, 7/3/2007] In some respects Miller’s testimony is less than enlightening. She admits that Lewis Libby was the source that she was protecting (see September 15, 2005), but says that she doesn’t believe Libby told her Plame Wilson’s name. In the same notebook Miller used to take notes from her conversations with Libby (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003), Miller wrote “Valerie Flame,” an apparent misspelling. Asked why that name appears in the notebook alongside the notes from her conversations with Libby, Miller equivocates, saying she doesn’t believe she heard the name from Libby. She will later write of her testimony, “I said I believed the information came from another source, whom I could not recall.” As a side note, the Times only now reveals Libby as Miller’s source, though other news outlets have already identified Libby. [New York Times, 10/16/2005] Miller testifies that she does not recall her first meeting with Libby, which took place June 23. She will change her testimony (see October 7, 2005 and October 12, 2005) after prosecutor Patrick Fitzgerald shows her Secret Service logs showing that she had met with Libby in the Executive Office Building. [National Journal, 10/20/2005] This memory lapse is consistent with theories that Miller may be attempting to protect Libby by failing to testify about that first meeting, where Libby informed Miller that Plame Wilson was a CIA official working in the Weapons, Intelligence, Non-Proliferation, and Arms Control office (see September 29-30, 2005). Miller also testifies that Libby saw the media’s reporting of the Iraq-Niger story as the product of “selective leaking” by the CIA. The purpose of the CIA leaks, Miller says Libby believed, was to protect the agency if no WMD were found in Iraq. [Roberts, 2008, pp. 151]
