Feith and Deputy Secretary of Defense Paul Wolfowitz, both staunch neoconservatives, rename the Northern Gulf Affairs Office on the Pentagon’s fourth floor (in the seventh corridor of D Ring) the “Office of Special Plans” (OSP) and increase its four-person staff to sixteen. [Knight Ridder, 8/16/2002; Los Angeles Times, 11/24/2002; New Yorker, 5/12/2003; Inter Press Service, 8/7/2003; Tom Paine (.com), 8/27/2003; American Conservative, 12/1/2003; Mother Jones, 1/2004] William Luti, a former navy officer and ex-aide to Vice President Cheney, is put in charge of the day-to-day operations [Guardian, 7/17/2003; Mother Jones, 1/2004] , apparently at the behest of Cheney. Luti was, according to former Defense Intelligence Agency official Patrick Lang, a member of Cheney’s “shadow National Security Council.” [Middle East Policy Council, 6/2004]
Transforming NESA - Luti worked for the Near East and South Asian Affairs desk (NESA) at the Pentagon since mid-2001. Lang later describes NESA as having been “a Pentagon backwater, responsible primarily for arranging bilateral meetings with military counterparts” from various nations. Before the Afghanistan war, NESA worked closely with the Defense Intelligence Agency’s Defense Intelligence Officer (DIO) for the Near East, South Asia, and Counterterrorism. During Luti’s first months at NESA, the DIO was Bruce Hardcastle. The Pentagon dismantled the entire DIO system, partly because of friction between Luti and Hardcastle (see Early 2002). Lang will write, “The roots of the friction between Hardcastle and Luti were straightforward: Hardcastle brought with him the combined wisdom of the professional military intelligence community. The community had serious doubts about the lethality of the threat from Saddam Hussein, the terrorism links and the status of the Iraqi WMD programs. Luti could not accept this. He knew what he wanted: to bring down Saddam Hussein. Hardcastle could not accept the very idea of allowing a desired outcome to shape the results of analysis.” Luti transforms NESA into what Lang will call “a ‘de facto’ arm of the vice president’s office,” and in the process shuts Hardcastle out of NESA (and later OSP) intelligence briefings. Luti does not report to either Feith or Donald Rumsfeld, as his chain of command delineates, but to Cheney’s chief of staff, Lewis “Scooter” Libby. OSP staffer Karen Kwiatkowski later recalls being “shocked” to learn that Luti reports to Libby and not to his putative Pentagon superiors. She will say, “In one of the first staff meetings that I attended there, Bill Luti said, ‘Well, did you get that thing over to Scooter? Scooter wants this, and somebody’s got to get it over to him, and get that up to him right away.’ After the meeting, I asked one of my co-workers, who’d been there longer, ‘Who is this Scooter?’ I was told, ‘That’s Scooter Libby over at the OVP (Office of the Vice President). He’s the Vice President’s chief of staff.’ Later I came to understand that Cheney had put Luti there.” Under Luti, NESA becomes a virtual adjunct to the OSP. Strong Neoconservative Influence - The Office of Special Plans is staffed with a tight group of like-minded neoconservative ideologues, who are known advocates of regime change in Iraq. Notably, the staffers have little background in intelligence or Iraqi history and culture. [Salon, 7/16/2003; Inter Press Service, 8/7/2003; American Conservative, 12/1/2003; Mother Jones, 1/2004] Some of the people associated with this office were earlier involved with the Counter Terrorism Evaluation Group, also known as the “Wurmser-Maloof” project (see Shortly After September 11, 2001). They hire “scores of temporary ‘consultants‘… including like-minded lawyers, congressional staffers, and policy wonks from the numerous right-wing think-tanks in the US capital.” Neoconservative ideologues, like Richard Perle, Michael Ledeen, and Newt Gingrich, are afforded direct input into the Office of Special Plans. [Guardian, 7/17/2003; Mother Jones, 1/2004; Vanity Fair, 7/2006, pp. 150] Kwiatkowski later says she saw Ledeen going “in and out of there (OSP) all the time.” [Vanity Fair, 7/2006, pp. 150]
Planning for Post-Saddam Iraq - The official business of Special Plans is to help plan for post-Saddam Iraq. The office’s staff members presumably “develop defense policies aimed at building an international coalition, prepare the secretary of defense and his top deputies for interagency meetings, coordinate troop-deployment orders, craft policies for dealing with prisoners of war and illegal combatants, postwar assistance and reconstruction policy planning, postwar governance, Iraqi oil infrastructure policy, postwar Iraqi property disputes, war crimes and atrocities, war-plan review and, in their spare time, prepare congressional testimony for their principals.” [Insight, 12/2/2003]
Covert Source of 'Alternative' Intelligence - But according to numerous well-placed sources, the office becomes a source for many of the administration’s prewar allegations against Iraq. It is accused of exaggerating, politicizing, and misrepresenting intelligence, which is “stovepiped” to top administration officials who use the intelligence in their policy decisions on Iraq. 'Top Secret' - There are very few news reports in the American mainstream media that report on the office. In fact, the office is reportedly Top Secret. [Bamford, 2004, pp. 308] “We were instructed at a staff meeting that this office was not to be discussed or explained,” Kwiatkowski will later say, “and if people in the Joint Staff, among others, asked, we were to offer no comment.” [American Conservative, 12/1/2003]
Part of a 'Separate Government,' Powell Feels - Colin Powell is said to have felt that Cheney and the neoconservatives in this “Gestapo” office had established what was essentially a separate government. [Washington Post, 4/17/2004] Powell’s former chief of staff, Larry Wilkerson, is even more blunt. “When I say ‘secret cabal,’ I mean ‘secret cabal,’ he says of the White House officials behind the OSP. He compares Cheney, Rumsfeld, and the neoconservatives to the Jacobins, the radical zealots who plunged 18th-century France into the Reign of Terror. “I see them as messianic advocates of American power from one end of the globe, much as the Jacobins in France were messianic advocates of the French Revolution. I don’t care whether utopians are Vladimir Lenin on a sealed train to Moscow or Paul Wolfowitz. You’re never going to bring utopia, and you’re going to hurt a lot of people in the process.” [Unger, 2007, pp. 299-300] Among the claims critics find most troubling about the office are:
Heavy Reliance on Intelligence from Exiles and Defectors - The office relies heavily on accounts from Iraqi exiles and defectors associated with Ahmed Chalabi’s Iraqi National Congress (INC), long considered suspect by other US intelligence agencies. [New Yorker, 5/12/2003; Salon, 7/16/2003; Guardian, 7/17/2003; Inter Press Service, 8/7/2003; Independent, 9/30/2003; Mother Jones, 1/2004] One defector in particular, code-named “Curveball,” provides as much as 98 percent of the intelligence on Iraq’s alleged arsenal of biological weapons. [CNN, 7/11/2004] Much of the information provided by the INC’s sources consists of “misleading and often faked intelligence reports,” which often flow to Special Plans and NESA directly, “sometimes through Defense Intelligence Agency debriefings of Iraqi defectors via the Defense Human Intelligence Service and sometimes through the INC’s own US-funded Intelligence Collection Program, which was overseen by the Pentagon.” [Mother Jones, 1/2004] According to Kwiatkowski, the movement of intelligence from the INC to the Office of Special Plans is facilitated by a Colonel Bruner, a former military aide to Gingrich. [Newsweek, 12/15/2003; Mother Jones, 1/2004; Salon, 3/10/2004] Bruner “was Chalabi’s handler,” Kwiatkowski will tell Mother Jones. “He would arrange meetings with Chalabi and Chalabi’s folks.” [Mother Jones, 1/2004] Kwiatkowski also finds that OSP personnel, along with DIA and CIA officials, are taking part in the debriefing of INC informants. She will recall confronting one DIA officer, John Trigilio, about the practice: “I argued with [Tregilio] after the president’s Cincinnati speech (see October 5, 2002 and October 6, 2002). I told him that the president had made a number of statements that were just not supported by the intelligence. He said that the president’s statements are supported by intelligence, and he would finally say, ‘We have sources that you don’t have.’ I took it to mean the sources that Chalabi was bringing in for debriefing… Trigilio told me he participated in a number of debriefs, conducted in hotels downtown, or wherever, of people that Chalabi brought in. These debriefs had Trigilio from OSP, but also CIA and DIA participated… If [the information] sounded good, it would go straight to the OVP or elsewhere. I don’t put it out of possibility that the information would go straight to the media because of the (media’s) close relationship with some of the neoconservatives. So this information would make it straight out into the knowledge base without waiting for intelligence [analysts] to come by with their qualifications and reservations.” [Middle East Policy Council, 6/2004]
Cherry-Picked Intelligence - The Office of Special Plans purposefully ignores intelligence that undermines the case for war while exaggerating any leads that support it. “It wasn’t intelligence—it was propaganda,” Kwiatkowski will later explain. “They’d take a little bit of intelligence, cherry-pick it, make it sound much more exciting, usually by taking it out of context, often by juxtaposition of two pieces of information that don’t belong together.” [New York Times, 10/24/2002; New Yorker, 5/12/2003; Salon, 7/16/2003; Guardian, 7/17/2003; Inter Press Service, 8/7/2003; Independent, 9/30/2003; Mother Jones, 1/2004] “At the OSP, what they were doing was looking at all the intelligence they could find on WMD. That was the focal point, picking bits and pieces that were the most inflammatory, removing any context that might have been provided in the original intelligence report, that would have caused you to have some pause in believing it or reflected doubts that the intelligence community had, so if the intelligence community had doubts, those would be left out… They would take items that had occurred many years ago, and put them in the present tense, make it seem like they occurred not many years ago… But they would not talk about the dates; they would say things like, ‘He has continued since that time’ and ‘He could do it tomorrow,’ which of course, wasn’t true… The other thing they would do would be to take unrelated events that were reported in totally unrelated ways and make connections that the intelligence community had not made. This was primarily in discussing Iraq’s activities and how they might be related to al-Qaeda or other terrorist groups that might be against us, or against Israel… These kinds of links would be made. They would be made casually, and they would be made in a calculated way to form an image that is definitely not the image that anyone reading the original reports would have. The summaries that we would see from Intelligence did not match the kinds of things that OSP was putting out. So that is what I call propaganda development. It goes beyond the manipulation of intelligence to propaganda development.” [Middle East Policy Council, 6/2004]
No Intelligence Oversight - The OSP bypasses established oversight procedures by sending its intelligence assessments directly to the White House and National Security Council without having them first vetted by a review process involving other US intelligence agencies. [New Yorker, 5/12/2003; Salon, 7/16/2003; Guardian, 7/17/2003; Mother Jones, 1/2004] The people at Special Plans are so successful at bypassing conventional procedures, in part, because their neoconservative colleagues hold key positions in several other agencies and offices. Their contacts in other agencies include: John Bolton, undersecretary of state for arms control and international security; Bolton’s adviser, David Wurmser, a former research fellow on the Middle East at the American Enterprise Institute, who was just recently working in a secret Pentagon planning unit at Douglas Feith’s office (see Shortly After September 11, 2001); Elizabeth Cheney, deputy assistant secretary of state for Near East Affairs; Stephen Hadley, the deputy national security adviser; Elliott Abrams, the National Security Council’s top Middle East aide; and Richard Perle, Newt Gingrich, James Woolsey and Kenneth Adelman of the Defense Policy Board. The office provides very little information about its work to other US intelligence offices. [Salon, 7/16/2003; Guardian, 7/17/2003; Inter Press Service, 8/7/2003]
'Stealth Organization' - Greg Thielmann, the former director of the Strategic, Proliferation and Military Affairs Office at the State Department’s Intelligence Bureau, later says of the OSP: “It was a stealth organization. They didn’t play in the intelligence community proceedings that our office participated in. When the intelligence community met as a community, there was no OSP represented in these sessions. Because, if they had done that, they would have had to subject their views to peer review. Why do that when you can send stuff right in to the vice president?” [Middle East Policy Council, 6/2004; Unger, 2007, pp. 299] Lang will say in January 2004 that what happened was fundamentally different from anything that had happened under previous presidents. Cheney’s staff and allies “behaved as though they had seized control of the government in a ‘silent coup,’” The result, according to Lang, is “a highly corrupted system of intelligence and policymaking, one twisted to serve specific group goals, ends, and beliefs held to the point of religious faith.” [Unger, 2007, pp. 301]
Pressuring Intelligence Analysts - Retired Marine Lieutenant Colonel Dale Davis, who headed the International Programs Department at the Virginia Military Institute until March 2004, and an expert on Middle East affairs, later says he believes intelligence analysts at the CIA and other agencies were pressured indirectly. Davis will say, “By creating the OSP [Office of Special Plans], Cheney was able to say, ‘Hey, look at what we’re getting out of OSP. How come you guys aren’t doing as well? What is your response to what this alternative analysis that we’re receiving from the Pentagon says?’ That’s how you do it. You pressure people indirectly.” Vincent Cannistraro, a former senior counterterrorism official with the CIA, will agree: “Over a long period of time, there was a subtle process of pressure and intimidation until people started giving them what was wanted… When the Senate Intelligence Committee interviewed, under oath, over 100 analysts, not one of them said, ‘I changed my assessment because of pressure.‘… The environment was conditioned in such a way that the analyst subtly leaned toward the conceits of the policymakers… The intelligence community was vulnerable to the aggressiveness of neoconservative policymakers, particularly at the Pentagon and at the VP’s office. As one analyst said to me, ‘You can’t fight something with nothing, and those people had something. Whether it was right or wrong, fraudulent or specious, it almost didn’t make any difference, because the policymakers believed it already, and if you didn’t have hard countervailing evidence to persuade them, then you were at a loss.’” [Middle East Policy Council, 6/2004]
Strong Pro-Israel, Anti-Arab Biases - Lastly, the people involved in Special Plans openly exhibit strong pro-Israel and anti-Arab bias. The problem, note critics, is that the analysis of intelligence is supposed to be apolitical and untainted by ideological viewpoints. [American Conservative, 12/1/2003] According to a CIA intelligence official and four members of the Senate’s Intelligence Committee, Special Plans is the group responsible for the claim Bush will make in his 2003 State of the Union address that Iraq had attempted to procure uranium from an African country (see 9:01 pm January 28, 2003). [Nation, 6/19/2003; Information Clearing House, 7/16/2003]
Personal Grudges against Intelligence Community - The OSP reflects the personal grudges and ill will of many in the Office of the Vice President against the intelligence community, in part because of the CIA’s refusal to give much weight to the claims of Chalabi and the INC. “This had been a fight for such a long period of time, where people were so dug in,” a friend of one of Vice President Cheney’s senior staffers will later reflect. A colleague of the senior staff later says, “They so believed that the CIA were wrong, they were like, ‘We want to show these f_ckers that they are wrong.’” [New Republic, 11/20/2003]
Propaganda - Kwiatkowski will later recall that the OSP generated a large amount of what she terms propaganda, in the form of “talking points” used in briefings and in press conferences. “With the talking points, many of the propagandistic bullets that were given to use in papers for our superiors to inform them—internal propaganda—many of those same phrases and assumptions and tones, I saw in Vice President Cheney’s speeches and the president’s speeches,” she will say. “So I got the impression that those talking points were not just for us, but were the core of an overall agenda for a disciplined product, beyond the Pentagon. Over at the vice president’s office and the [neoconservative news magazine] Weekly Standard, the media, and the neoconservative talking heads and that kind of thing, all on the same sheet of music.” Kwiatkowski identifies Abram Shulsky, a neoconservative academic and recent Pentagon hire, as the source of many of these talking points. Denials, Counter-Accusations after Public Learns of OSP - After the existence of the Office of Special Plans is revealed to the public, the Pentagon will deny that it served as a direct conduit to the White House for misleading intelligence, instead claiming that its activities had been limited to postwar plans for Iraq. [New Yorker, 5/12/2003] And a December 2003 opinion piece published in Insight magazine will call the allegations surrounding the Office of Special Plans the work of conspiracy theorists. Vice President Cheney, widely acknowledged as a master bureaucrat, uses a variety of bureaucratic strategies to craft his own foreign policy strategies, including the promotion the Office of Special Plans (OSP—see September 2002), simultaneously undercutting and marginalizing the CIA. Many senior intelligence officials have no idea that the OSP even exists. “I didn’t know about its existence,” Greg Thielmann, the director of the State Department’s in-house intelligence agency, the Bureau of Intelligence and Research (INR), will say.
Strategic Placement of Personal, Ideological Allies - Another Cheney strategy is personal placement. He moves his special adviser, neoconservative William Luti, into the OSP. Another influential neoconservative, Abram Shulsky, soon joins Luti there. A longtime associate of both Cheney and Defense Secretary Donald Rumsfeld, Stephen Cambone, becomes a special assistant to Rumsfeld (see Early 2001). Cheney now has his allies at the highest levels of the Pentagon. In Cheney’s office, chief of staff Lewis “Scooter” Libby serves as his liaison with the Pentagon. His chief counsel, David Addington, oversees Cheney’s aggressive and obsessively secretive legal staff. In the National Security Council (NSC), Stephen Hadley, Condoleezza Rice’s deputy, keeps a close eye on Rice in case she shows signs of falling back in with her old mentor, Brent Scowcroft (see August 1998). John Bolton and David Wurmser keep tabs on Colin Powell at the State Department. Cheney has John Yoo (see (After 10:00 a.m.) September 11, 2001) at the Justice Department. Not only does Cheney have highly placed loyalists in the State, Defense, and Justice Department, and in the NSC, he has vital allies in the Republican leadership in Congress.
Managing the Oval Office - Cheney handles the Oval Office himself. A Pentagon official who works closely with Cheney will later observe that President Bush handles the executive branch much as he handled the Texas Rangers baseball team: ignoring much of the daily functions, leaving most policy decisions to others and serving as a “corporate master of ceremonies, attending to the morale of the management team and focusing on narrow issues… that interested him.” Cheney becomes, in author Craig Unger’s words, “the sole framer of key issues for Bush,” the single conduit through which information reaches the president. Cheney, the Pentagon official will later say, “rendered the policy planning, development and implementation functions of the interagency system essentially irrelevant. He has, in matters he has deemed important, governed. As a matter of protocol, good manners, and constitutional deference, he has obtained the requisite ‘check-mark’ of the president, often during one-on-one meetings after a Potemkin ‘interagency process’ had run its often inconclusive course.” [Unger, 2007, pp. 249-250]

Neoconservative Michael Ledeen argues in a piece published by the Wall Street Journal that the US must not limit the next military strike to Iraq alone. Rather, according to Ledeen, the US “should instead be talking about using all our political, moral, and military genius to support a vast democratic revolution to liberate all the peoples of the Middle East from tyranny.” In addition to Iraq, he says, the governments of Iran, Syria, and Saudi Arabia must also be overthrown. “Stability is an unworthy American mission, and a misleading concept to boot. We do not want stability in Iran, Iraq, Syria, Lebanon, and even Saudi Arabia; we want things to change. The real issue is not whether, but how to destabilize.” [Wall Street Journal, 9/4/2002]

Wael Hamza Julaidan.Wael Hamza Julaidan. [Source: Public domain, via Evan Kohlmmann]The US and United Nations designate Wael Hamza Julaidan a terrorist financier and freezes the funds of the Rabita Trust. Julaidan worked with bin Laden’s mentor Abdullah Azzam in the Muslim World League in Pakistan in the 1980s and was one of the founders of al-Qaeda in 1988 (see August 11-20, 1988). [US News and World Report, 12/15/2003] Julaidan’s name was on the “Golden Chain” list of early al-Qaeda funders (see 1988-1989), serving as an intermediary between bin Laden and Saudi multimillionaires. Beginning in 2000, he became director general of the Rabita Trust, a Pakistani charity which the UN determined has been funding al-Qaeda. The US froze the bank accounts of the Rabita Trust shortly after 9/11 due to suspected terrorist links, but the organization changed its name and continued to operate (see Mid-September-October 12, 2001). Julaidan is considered highly connected in Saudi Arabia and even though the Saudi government officially goes along with the terrorist designations of Julaidan and the Rabita Trust, some top Saudi officials publicly defend him. For instance, Saudi Interior Minister Prince Nawaf bin Abdul Aziz publicly suggests that Julaidan is innocent. Julaidan is not arrested and the Saudi government offers no proof that they seized any of his or Rabita’s bank accounts. In December 2003, the Washington Post will report that US and UN officials believe Julaidan continues to work with charity fronts and handles large sums of money. During a joint press conference with US President George W. Bush and British Prime Minister Tony Blair, the two leaders make two factually incorrect statements, which are quickly contested by experts.
bullet Tony Blair states, “We only need to look at the report from the International Atomic Agency [IAEA] this morning showing what has been going on at the former nuclear weapons sites to realize that” Saddam is a real threat. [US President, 9/16/2002] But no such report exists. [Washington Times, 9/27/2002] What Blair is actually referring to is a set of commercial satellite photographs showing signs of new construction at a site the US had bombed in 1998. [MSNBC, 9/7/2002; Guardian, 9/9/2002; Associated Press, 9/10/2002] That same day, Mark Gwozdecky, a spokesman for the UN agency, says the agency had drawn no conclusion from those photographs. [MSNBC, 9/7/2002] On September 9, the Guardian of London will report that according to “a well-placed source” the photographs do not support Blair’s statement. “You cannot draw any conclusions,” the source explains. “The satellites were only looking at the top of a roof. You cannot tell without inspectors on the ground.” [Guardian, 9/9/2002] The following day, Hans Blix, head of UNMOVIC, will similarly tell reporters: “… [S]atellites don’t see through roofs. So we are not drawing conclusions from them. But it would be an important element in where, maybe, we want to go to inspect and monitor.” [Associated Press, 9/10/2002; Globe and Mail, 9/11/2002]
bullet Bush asserts, “I would remind you that when the inspectors first went into Iraq and were denied—finally denied access [in 1998], a report came out of the Atomic—the IAEA that they were six months away from developing a weapon,” adding, “I don’t know what more evidence we need.” [US President, 9/16/2002; Washington Times, 9/27/2002] But Bush’s statement is quickly refuted by an MSNBC news report published later that day, which includes an excerpt from the summary of the 1998 IAEA report Bush cited. The summary reads, “[B]ased on all credible information available to date… the IAEA has found no indication of Iraq having achieved its program goal of producing nuclear weapons or of Iraq having retained a physical capability for the production of weapon-useable nuclear material or having clandestinely obtained such material.” [MSNBC, 9/7/2002; Dean, 2004, pp. 138] The text of the actual report, authored by IAEA Director-General Mohamed ElBaradei, reads: “There are no indications that there remains in Iraq any physical capability for the production of weapon-usable nuclear material of any practical significance.” [Washington Times, 9/27/2002] When confronted by MSNBC reporters on this point, an unnamed senior White House official states, “What happened was, we formed our own conclusions based on the report.” [MSNBC, 9/7/2002] Later, when The Washington Times presses Deputy Press Secretary Scott McClellan for an explanation, he says, “[Bush is] referring to 1991 there. In ‘91, there was a report saying that after the war they found out they were about six months away.” But this too is challenged by Gwozdecky, spokesman for the UN agency, who says that no such report was ever published by the IAEA in 1991. Apparently the President’s accusations are based on two news articles that were published more than a decade ago—“a July 16 [2001] story in the London Times by Michael Evans and a July 18 [2001] story in the New York Times by Paul Lewis.” But as The Washington Times notes, “Neither article cites an IAEA report on Iraq’s nuclear-weapons program or states that Saddam was only six months away from ‘developing a weapon’—as claimed by Mr. Bush.” Instead the two news articles reported that at that time, UN inspectors had concluded that Iraq was only six months away from the large-scale production of enriched uranium. But as the 1998 report shows, both 1991 news stories are outdated. [Washington Times, 9/27/2002]

Mysterious 'Courtesy Call' - Pollari can presumably set the record straight on the question of whether Iraq is trying to purchase aluminum tubes for manufacturing rockets or for use in building muclear weapons (see Between April 2001 and September 2002, April 11, 2001, July 25, 2002, September 24, 2002, October 1, 2002, Between December 2002 and January 2003, January 11, 2003, and March 7, 2003)—the aluminum tubes in question are exactly the same as the Italians use in their Medusa air-to-ground missile systems (see December 2002). Apparently Iraq is trying to reproduce “obsolete” missile systems dating back to when Italy and Iraq engaged in military trade. Pollari could also discuss the documents alleging that Iraq and Niger entered into a secret uranium deal (see Between Late 2000 and September 11, 2001), a set of documents originally promulgated by SISMI and now thoroughly discredited (see February 5, 2003). But apparently Pollari discusses none of this with White House officials. Hadley, who hosts the meeting with Pollari, will refuse to say what they discuss, except to label Pollari’s visit “just a courtesy call,” and will add, “Nobody participating in that meeting or asked about that meeting has any recollection of a discussion of natural uranium, or any recollection of any documents passed.”
Meeting with Hadley, Not Tenet, Significant - Author Craig Unger will write in 2007 that the real significance of the meeting is that Pollari meets with Hadley (widely considered an ally of Vice President Dick Cheney), and not with Pollari’s counterpart, CIA Director George Tenet. Former CIA officer Philip Giraldi later says, “It is completely out of protocol for the head of a foreign intelligence service to circumvent the CIA. It is uniquely unusual.” Of the Iraq-Niger documents, Giraldi will say, “In spite of lots of people having seen the documents, and having said they were not right, they went around them.” Former CIA and State Department analyst Melvin Goodman will concur. “To me there is no benign interpretation of” the Pollari-Hadley meeting, Goodman will say. “At the highest level it was known that the documents were forgeries. Stephen Hadley knew it. Condi Rice [Hadley’s supervisor] knew it. Everyone at the highest level knew.” Neoconservative columnist, author, and former Italian intelligence asset Michael Ledeen, who has close ties with both Pollari and Hadley and may have played a part in producing the Iraq-Niger forgeries (see December 9, 2001). will deny setting up the meeting. And a former CIA official speaking on Tenet’s behalf will say that Tenet has no information to suggest that Pollari or elements of SISMI were trying to circumvent the CIA and go directly to the White House. Downplaying Significance of Meeting - The Bush administration later insists the meeting was of little importance. Frederick Jones, a National Security Council spokesman, describes the meeting as a courtesy call of 15 minutes or less. He also says, “No one present at that meeting has any recollection of yellowcake [uranium oxide] being discussed or documents being provided.” [New York Times, 10/28/2005]
Meeting Remains Secret until 2005 - This meeting is not reported until 2005, when Italy’s La Repubblica reports that a meeting—arranged through a backchannel by Gianni Castellaneta, the Italian prime minister’s diplomatic advisor—took place between Pollari and Hadley on this date. The report is refuted by Italy which insists it was actually a short meeting between Pollari and Rice. Italy says that although Hadley was present, he was really not part of the meeting. [AGI online, 10/29/2005] It is not clear from the reporting, however, if the meeting acknowledged by Italy and Washington, is in fact the same meeting reported by La Repubblica.

[Source: September 11 News (.com)]The Bush administration’s public relations team decides to kick off its push for a war with Iraq, and its drive to the midterm elections, with President Bush’s speech commemorating the first anniversary of the 9/11 attacks. After much deliberation, Ellis Island in New York Harbor is chosen as the setting for Bush’s speech; the Ellis site won out over nearby Governors Island because the senior public relations officials want the Statue of Liberty as a backdrop. “We had made a decision that this would be a compelling story either place,” White House communications director Dan Bartlett will later recall. “We sent a team out to go and look and they said, ‘This is a better shot,’ and we said okay.” Leading that team is Scott Sforza, the former ABC producer who will later oversee the May 2003 “Mission Accomplished” event (see May 1, 2003 and April 30, 2008). [Rich, 2006, pp. 57-58] (Deputy press secretary Scott McClellan will later write of Sforza, “Reagan’s team had perfected this art of stagecraft, and the man in charge for Bush, deputy communications director Scott Sforza, took it to new heights.” [McClellan, 2008, pp. 82] Sforza is joined by former Fox News producer Gary Jenkins and former NBC cameraman Bob De Servi. They use three barges laden with stadium lights to illuminate the Statue of Liberty for the shoot. Former Reagan administration public relations chief Michael Deaver will later observe that the Bush team is far better at this kind of marketing presentation than the Reagan, Bush I, or Clinton public relations teams ever were. “[T]hey’ve taken it to an art form,” Deaver will say. The speech is designed to push Congress towards authorizing the war before the midterm elections (see January 19, 2002 and October 10, 2002), when, as author Frank Rich will later write, “the pressure on congressmen facing re-election to prove their war-waging machismo would be at its nastiest. Any weak sisters could expect a thrashing much like that Republicans inflicted on Democrats who had failed to vote for the ‘use of force’ resolution sought by the first President Bush after the Persian Gulf War in 1991” (see January 9-13, 1991). A senior administration official says, “In the end it will be difficult for someone to vote against it.” [Rich, 2006, pp. 57-58] In other preparatory moves for the speech, the government raises the National Threat Level from yellow to orange (see September 10, 2002), and announces the death or capture of some 2,700 al-Qaeda operatives since 9/11 (see September 10, 2002). The administration will also attempt to significantly revise its account of events on 9/11 itself (see September 11, 2002).

The White House publishes a 26-page government white paper titled, “A Decade of Deception and Defiance,” which seeks to demonstrate that Saddam Hussein represents a serious and imminent threat to the United States. The report, written by White House Iraq Group member James Wilkinson, relies primarily on public sources, including reports that have been published by human rights groups and the State Department, as well as various newspaper articles, including two by the New York Times. [Isikoff and Corn, 2006, pp. 48] Section 5 of the report deals with “Saddam Hussein’s support for international terrorism,” though it makes no attempt to tie Hussein’s government to al-Qaeda or Osama bin Laden. It lists six points linking Saddam Hussein to terrorist activities, some dating as far back as the ‘70s. One of the points criticizes Iraq for its ties to the Mujahadeen-e Khalq Organization (MKO), an obscure militant Iranian dissident group whose main office is in Baghdad. The report says: “Iraq shelters terrorist groups including the Mujahedin-e-Khalq Organization (MKO), which has used terrorist violence against Iran and in the 1970s was responsible for killing several US military personnel and US civilians.” The paper notes that the US State Department classified MKO as a “foreign terrorist organization” in 1997, “accusing the Baghdad-based group of a long series of bombings, guerilla cross-border raids and targeted assassinations of Iranian leaders.” [Newsweek, 9/26/2002 Sources: Richard Durbin] The administration is quickly ridiculed for making the claim when, two weeks later, Newsweek reports that MKO’s front organization, the National Council of Resistance of Iran, has a small office in the National Press Building in Washington, DC. It is also reported that only two years beforehand this very group had been supported by then-Senator John Ashcroft and more than 200 other members of Congress. On several issues the senator and his colleagues had expressed solidarity with MKO at the behest of their Iranian-American constituencies. [Newsweek, 9/26/2002] Another allegation included in the paper states that Iraqi defector Adnan Ihsan Saeed al-Haideri, a civil engineer, “had visited twenty secret facilities for chemical, biological, and nuclear weapons.” According to the White House dossier, Haideri “supported his claims with stacks of Iraqi government contracts, complete with technical specifications.” Ten months earlier, the CIA had debriefed Haideri in Bangkok and concluded from the results of a polygraph that Haideri account was a complete fabrication (see December 17, 2001). I can’t imagine an elected United States—elected member of the United States Senate or House of Representatives saying, I think I’m going to wait for the United Nations to make a decision. It seems like to me that if you’re representing the United States, you ought to be making a decision on what’s best for the United States. If I were running for office, I’m not sure how I’d explain to the American people—say, vote for me, and, oh, by the way, on a matter of national security, I think I’m going to wait for somebody else to act.… My answer to the Congress is, they need to debate this issue and consult with us, and get the issue done as quickly as possible. Two days before the CIA is to issue an assessment (see August 2002) on Iraq’s supposed links to militant Islamic groups, Defense Department officials working in the Office of Special Plans (OSP) deliver a briefing in the White House to several top officials, including I. Lewis Libby, Vice President Dick Cheney’s chief of staff, and Deputy National Security Adviser Stephen Hadley. The briefing is entitled “Assessing the Relationship between Iraq and al-Qaeda,” and is an updated version of a briefing presented in July 2002 (see July 25, 2002). The OSP, working under Undersecretary of Defense for Policy Douglas J. Feith, is aggressively promoting any evidence it can find to support a decision to invade Iraq (see September 2002).
bullet The briefing claims that the relationship between Iraq and al-Qaeda is “mature” and “symbiotic,” and marked by shared interests.

Around the same time, the briefing is also presented with slight variations to Defense Secretary Donald Rumsfeld and CIA Director George Tenet. The slide criticizing other intelligence agencies is excluded when a version of the briefing is given to Tenet. A later report by the Defense Department’s Office of Inspector General will conclude the briefing was entirely incorrect and deliberately ignored intelligence by the CIA, DIA, and other intelligence agencies that contradicted its conclusions (see February 9, 2007). [Washington Post, 4/6/2007] The CIA has already found the majority of the information in the presentation either completely false or largely unsupported by reliable evidence. [Savage, 2007, pp. 293]
Unusual Briefing - This briefing, delivered at the same time the White House is pressing Congress to authorize the upcoming war with Iraq (see October 11, 2002), is, in the words of author and reporter Charlie Savage, “highly unusual.” Usually, high-level administration officials making national security decisions rely on information vetted by top-flight analysts at the CIA, in order to ensure the information is as accurate and politically neutral as possible. No CIA analyst has ever found a meaningful link between Hussein and al-Qaeda; the few reports of such claims were seen as highly dubious. But Cheney and his supporters consider the CIA slow, pedantic, and incompetent, and believe Feith’s OSP can provide better—or at least more amenable—intelligence. Savage will write: “In Feith’s shop and elsewhere in the executive branch, neoconservative political appointees stitched together raw intelligence reports, often of dubious credibility, without any vetting or analysis by professional intelligence specialists. The officials cherry-picked the files for reports that supported the notion that Iraq had an active [WMD] program and that it was working hand-in-hand with al-Qaeda, ‘stovepiping’ such reports to top decision makers (and leaking them to the press) while discounting any skepticism mounted by the professionals.” [Savage, 2007, pp. 292]
Dismantling Intelligence Filtering System in Favor of Politically Controlled Intelligence Provisions - What the presentation accomplishes, according to former CIA intelligence analyst Kenneth Pollock, is to support a conclusion already drawn—the need to get rid of Saddam Hussein—by using slanted, altered, and sometimes entirely fabricated “intelligence.” The White House proceeded to “dismantle the existing filtering process that for 50 years had been preventing the policymakers from getting bad information.” Savage goes one step farther. He will write that the presentation is part of a larger White House strategy to alter the balance of power between the presidency and a key element of the bureaucracy. By setting up a politically controlled alternative intelligence filtering system, he will write, “the administration succeeded in diminishing the power of the CIA’s information bureaucracy to check the White House’s desired course of action.” [Savage, 2007, pp. 294]

CIA Director George Tenet testifies before the Senate Intelligence Committee. On the subject of alleged connections between Iraq and al-Qaeda, Tenet, using a recently released CIA draft report entitled “Iraqi Support for Terrorism,” tells the panel that no evidence of any such connections exists. Iraq had no foreknowledge of the 9/11 attacks or any other al-Qaeda strike, Tenet says. He testifies: “The intelligence indicates that the two sides at various points have discussed safe-haven, training, and reciprocal non-aggression. There are several reported suggestions by al-Qaeda to Iraq about joint terrorist ventures, but in no case can we establish that Iraq accepted or followed up on these suggestions.” [Center for Public Integrity, 1/23/2008]

Defense Secretary Donald Rumsfeld warns the House Armed Services Committee of the serious and imminent threat that Saddam Hussein poses to Western countries. He says: “No terrorist state poses a greater and more immediate threat to the security of our people and the stability of the world than the regime of Saddam Hussein.” He adds: “What has not changed is Iraq’s drive to acquire those weapons of mass destruction, and the fact that every approach that the United Nations has taken to stop Iraq’s drive has failed. This is a critical moment for our country and for the world. Our resolve is being put to the test. It is a test unfortunately the world’s free nations have failed before in recent history with unfortunate consequences.” [US Congress, 9/18/2002; Daily Telegraph, 9/19/2002; Agence France-Presse, 9/19/2002] Rumsfeld says of Iraq’s putative nuclear weapons program, “Some have argued that the nuclear threat from Iraq is not imminent—that Saddam [Hussein] is at least 5-7 years away from having nuclear weapons. I would not be so certain…. He has, at this moment, stockpiles of chemical and biological weapons, and is pursuing nuclear weapons.” [Salon, 3/6/2004] The Secretary of Defense also says that Congress must authorize the president to use military force against Iraq before the Security Council votes on the issue. “Delaying a vote in the Congress would send a message that the US may be unprepared to take a stand, just as we are asking the international community to take a stand and as we are cautioning the Iraqi regime to consider its options,” argues Rumsfeld, adding, “Our job today—the president’s, the Congress’ and the United Nations’—is to… anticipate vastly more lethal attacks before they happen and to make the right decision as to whether or not it’s appropriate for this country to take action…. The goal is not inspections, the goal is disarmament.” [US Congress, 9/18/2002; Associated Press, 9/19/2002] He also tries to discredit Iraq’s September 16, 2002 (see September 16, 2002), offer to admit UN inspectors without conditions. He says: “There’s no doubt in my mind but that the inspection program that currently is on the books wouldn’t work because it’s so much weaker than the earlier one. The more inspectors that are in there, the less likely something is going to happen. The longer nothing happens, the more advanced their weapons programs go along.” [US Congress, 9/18/2002] Rumsfeld is drastically revising his own stance from over a year before, when he told an interviewer on February 12, 2001, that Iraq was “probably not a nuclear threat” (see February 12, 2001).

The White House delivers a draft of a strongly worded resolution to Congress authorizing the president to use “all appropriate means” against Iraq. The 20-paragraph draft includes provisions that would allow Bush to ignore the UN and “use all means that he determines to be appropriate, including force, in order to enforce” the UN’s Security Council resolutions, “defend the national security interests of the United States against the threat posed by Iraq, and restore international peace and security in the region.” According to the Associated Press, “Three senior White House aides familiar with the draft said it would give Bush maximum flexibility to confront the threat posed by Iraqi weapons of mass destruction, including an explicit OK to use military force.” Although numerous congresspersons complain that the proposed wording of the resolution would provide Bush with a blank check to use military force anywhere in the Middle East and Persian Gulf, several senators—Democrats and Republicans alike—say that an amended version of the resolution would likely pass. That the United Nations Security Council must work with the United States and Britain and other concerned parties to send a clear message that we expect Saddam to disarm. And if the United Nations Security Council won’t deal with the problem, the United States and some of our friends will.” Allies of the US that Bush expects to join in moving against Iraq “heard me loud and clear when I said, either you can be the United Nations, a capable body, a body able to keep the peace, or you can be the League of Nations.” Of the resolution, Bush says, “I am sending suggested language for a resolution. I want—I’ve asked for Congress’ support to enable the administration to keep the peace. And we look forward to a good, constructive debate in Congress.” Bush emphasizes that the resolution must pass before the upcoming November midterm elections: “I appreciate the fact that the leadership recognizes we’ve got to move before the elections” (see September 24, 2002). The Bush administration submits to Congress a 31-page document entitled “The National Security Strategy of the United States.”
Preemptive War - The National Security Strategy (NSS) openly advocates the necessity for the US to engage in “preemptive war” against nations it believes are likely to become a threat to the US’s security. It declares: “In an age where the enemies of civilization openly and actively seek the world’s most destructive technologies, the United States cannot remain idle. The United States will, if necessary, act preemptively.” The declaration that the US will engage in preemptive war with other nations reverses decades of American military and foreign policy stances; until now, the US has held that it would only launch an attack against another nation if it had been attacked first, or if American lives were in imminent danger. President Bush had first mentioned the new policy in a speech in June 2002 (see June 1, 2002), and it echoes policies proposed by Paul Wolfowitz during the George H. W. Bush administration (see March 8, 1992). [Shenon, 2008, pp. 128]
US Must Maintain Military 'Beyond Challenge' - The National Security Strategy states that the ultimate objective of US national security policy is to “dissuade future military competition.” The US must therefore “build and maintain our defenses beyond challenge. Our forces will be strong enough to dissuade potential adversaries from pursuing a military build-up in hopes of surpassing, or equaling, the power of the United States.” [London Times, 9/21/2002]
Ignoring the International Criminal Court - The NSS also states, “We will take the actions necessary to ensure that our efforts to meet our global security commitments and protect Americans are not impaired by the potential for investigations, inquiry, or prosecution by the International Criminal Court (ICC), whose jurisdiction does not extend to Americans and which we do not accept.” [US President, 9/2002]
Declaring War on Terrorism Itself - It states: “The enemy is not a single political regime or person or religion or ideology. The enemy is terrorism—premeditated, politically motivated violence perpetrated against innocents.” Journalism professor Mark Danner will later comment in the New York Times: “Not Islamic terrorism or Middle Eastern terrorism or even terrorism directed against the United States: terrorism itself. ‘Declaring war on “terror,”’ as one military strategist later remarked to me, ‘is like declaring war on air power.’” [New York Times Magazine, 9/11/2005]
Fundamental Reversal of Containment, Deterrence Principles - Washington Post reporter Tim Reich later describes the NSS as “revers[ing] the fundamental principles that have guided successive presidents for more than 50 years: containment and deterrence.” Foreign policy professor Andrew Bacevich will write that the NSS is a “fusion of breathtaking utopianism [and] barely disguised machtpolitik.” Bacevich continues, “It reads as if it were the product not of sober, ostensibly conservative Republicans but of an unlikely collaboration between Woodrow Wilson and the elder Field Marshal von Moltke.” [American Conservative, 3/24/2003]
Written by Future Executive Director of 9/11 Commission - The document is released under George W. Bush’s signature, but was written by Philip D. Zelikow, formerly a member of the previous Bush administration’s National Security Council, and currently a history professor at the University of Virginia and a member of the Foreign Intelligence Advisory Board. Zelikow produced the document at the behest of his longtime colleague National Security Adviser Condoleezza Rice (see June 1, 2002). His authorship of the document will not be revealed until well after he is appointed executive director of the 9/11 commission (see Mid-December 2002-March 2003). Many on the Commission will consider Zelikow’s authorship of the document a prima facie conflict of interest, and fear that Zelikow’s position on the Commission will be used to further the Bush administration’s doctrine of preemptive war (see March 21, 2004). Deputy National Security Adviser Stephen J. Hadley convenes a meeting in the White House Situation Room to discuss Iraq with Colin Powell, George Tenet, and Donald Rumsfeld. The White House wants to be sure they are all on the same page when they testify before Congress next week. When a CIA officer notes that the alleged ties between Iraq and al-Qaeda are not supported by current intelligence, Douglas Feith cuts in insisting that Mohamed Atta had met an Iraqi agent in Prague, and that the director of Iraqi intelligence had met with Osama bin Laden in 1996. Both theories have been dismissed by the intelligence community. After a few minutes, Hadley cuts him off and tells him to sit down. [Isikoff and Corn, 2006, pp. 113-114]

David Albright, a physicist who helped investigate Iraq’s nuclear weapons program following the 1991 Persian Gulf War as a member of the International Atomic Energy Agency’s inspection team, concludes in a study that Iraq’s attempt to import aluminum tubes is not “evidence that Iraq is in possession of, or close to possessing, nuclear weapons” or that Iraq has an operating centrifuge plant. His assessment is based on several factors, including the fact that the tubes are made of an aluminum alloy that is ill-suited for welding. He notes that Iraq had used maraging steel and carbon fiber in its earlier attempts to make centrifuges (see (Late 1980s)). Albright also challenges the CIA’s contention the tubes’ anodized coating is an indication that they are meant to be used as rotors in a gas centrifuge. The nuclear physicist notes that the fact the tubes are anodized actually supports the theory that they were meant to be used in rockets, not a centrifuge. He cites another expert who said that an “anodized layer on the inside of the tube… can result in hampering the operation of the centrifuge.” [Albright, 10/9/2003 Sources: David Albright] Though Albright is critical of the charges being made by the Bush administration against Iraq, concerning nuclear weapons, he is no sympathizer of Saddam Hussein. He believes that Iraq has weapons of mass destruction and advocates a tough stance towards his regime. Several other newspapers also cover Albright’s report. Within “two hours and ten minutes” of the British dossier’s publication (see September 24, 2002), Iraqi government officials invite British journalists on a tour of the sites named in the document as suspected weapon sites. The journalists are permitted to choose which facilities, of those mentioned in the dossier, they want to visit.
Al-Qa'qa complex - The first site they visit is the al-Qa’qa complex, located 30 miles south of Baghdad, which according to the British government’s paper has “been repaired” and is now “operational.” “Of particular concern are elements of the phosgene production plant,” states the dossier, which makes two claims. The first is that the substance, phosgene, is being produced at the facility and can be used “as a chemical agent or as a precursor for nerve agent.” The second claim is that the facility’s phosgene production plants had been “dismantled under UNSCOM supervision, but have since been rebuilt.” [United Kingdom, 9/24/2002; Independent, 9/25/2002] Both claims are disputed by the Iraqis. Director-General Sinan Rasim Said concedes that the plants produce phosgene as a byproduct of centralit, a stabilizer for gunpowder (which is not illegal), but denies that it can be used “as a chemical agent or as a precursor for nerve agent,” as alleged in the British document. He explains to reporters that phosgene can “not be extracted from the manufacturing equipment, let alone be used for making nerve agents.” To support his claims, he says that during the Gulf War, the US had never attempted to destroy the phosgene plants “because they knew we can’t make use of it.” Instead they had bombed the boiler room and the storage area, he says. Said also disputes the claim that UNSCOM had attempted to dismantle the facility’s phosgene production plants. There was no reason to, he explains, because the plant was not in violation of any laws. He tells reporters that if the British had simply requested the relevant documents from the UN they would have seen that they were wrong. [Independent, 9/25/2002] Amir al Sa’adi, a senior Iraqi weapons expert, offers his own opinion as to why the facility was referred to in the dossier. He suggests that Blair singled out the plant “because it could produce propellant powder for weapons from pistols to artillery guns for Iraqi air defenses.” [Independent, 9/25/2002] UNMOVIC weapons inspectors will visit the site in February 2003 and find nothing. Amariyah Sera - The second site they visit is Amariyah Sera, a facility which the British say UNSCOM inspectors had concluded “was used to store biological agents, seed stocks and conduct biological warfare associated genetic research prior to the Gulf War.” [United Kingdom, 9/24/2002; Independent, 9/25/2002] It is also claimed by Downing Street that the facility “has now expanded its storage capacity,” implying that the expansion is related to biological weapons. [United Kingdom, 9/24/2002; Independent, 9/25/2002] But the facility’s director, Karim Obeid, disputes the dossier’s claim that UNSCOM had earlier determined the plant was used for genetic research and storing biological agents. He tells the Independent of London: “They were coming here ever since the Gulf War until they left, and they have never accused us of any of those things in that time. All our work was done with their supervision.” He says the facility is being used “for testing typhoid fever.” Moreover, he adds that he is morally opposed to biological warfare “both as a scientist and a human being.” [Independent, 9/25/2002] Obeid also explains that the storage capacity of the facility has been increased, as the dossier states, but that the additional rooms are not being used in a way that violates international law. A reporter from the Independent, who visits the additional rooms, reports that one of the added areas is “a large mostly empty room” which the director says is being used “to store solutions for blood tests, imported from the Melat pharmaceutical company in France,” while a second area is “stacked with empty bottles of various brands of vaccine.” [Independent, 9/25/2002] Weapons inspectors will visit the site on December 15, 16, and 22 and find no evidence of biological weapons. During a White House meeting with Colombian President Alvaro Uribe, George Bush makes the claim that Saddam Hussein and Osama bin Laden work together. “They’re both risks, they’re both dangerous,” Bush tells reporters. “The danger is, is that they work in concert,” he says in response to a question from a Reuters reporter. “The difference, of course, is that al-Qaeda likes to hijack governments. Saddam Hussein is a dictator of a government. Al-Qaeda hides, Saddam doesn’t, but the danger is, is that they work in concert. The danger is, is that al-Qaeda becomes an extension of Saddam’s madness and his hatred and his capacity to extend weapons of mass destruction around the world. Both of them need to be dealt with. The war on terror, you can’t distinguish between al-Qaeda and Saddam when you talk about the war on terror. And so it’s a comparison that is - I can’t make because I can’t distinguish between the two, because they’re both equally as bad, and equally as evil, and equally as destructive.” [Knight Ridder, 9/25/2002; Washington Post, 9/26/2002; US President, 9/30/2002; Center for Public Integrity, 1/23/2008] Later in the day, Bush’s comments are downplayed by White House Press Secretary Ari Fleischer, who says that Bush did not mean bin Laden and Hussein are working together, but rather that there is the danger that they could work together. He explains: “Clearly, al-Qaeda is operating inside Iraq. In the shadowy world of terrorism, sometimes there is no precise way to have definitive information until it is too late.” [Washington Post, 9/26/2002; White House, 9/25/2003] Bush fails to mention that the Defense Intelligence Agency has found no evidence of any such connections (see July 2002), or that eight days before his statement, the director of the CIA, George Tenet, told a Senate committee that no such connections can be shown to exist (see September 17, 2002). [Source: Oliver Willis]The candidates for governor of Maryland, Democrat Kathleen Kennedy Townsend and Republican Robert Ehrlich, hold a debate in the Murphy Fine Arts Building on the campus of Morgan State University in Baltimore. After the debate, allegations surface that Democratic supporters of Townsend threw Oreo cookies at Michael Steele, the Republican nominee for lieutenant governor. Steele is African-American; to label an African-American an “Oreo” is to say that he, like an Oreo cookie, is black on the outside and white on the inside. It is considered a significant racial slur. The allegations are published by, among other sources, the conservative Washington Times, largely relying on reporting by S.A. Miller, who writes multiple stories concerning the alleged incident.
First Iteration: Oreos 'Distributed' among Audience Members - The source is Ehrlich’s campaign spokesman Paul Schurick, who tells a Baltimore Sun reporter that he saw Democrats in the audience distributing Oreo cookies. Schurick initially makes no mention of anyone throwing cookies. One day after the event, Steele is quoted by the Sun as talking about the Townsend supporters in the crowd and what he terms “race-baiting” by her campaign, but says nothing about Oreos. On October 14, Weekly Standard columnist Jeffrey Goldberg repeats as fact Schurick’s allegations about Oreos being passed out at the debate. On October 21, syndicated conservative columnist George Will repeats the story, adding that “[s]ome of the audience had distributed Oreo cookies to insult Ehrlich’s running mate.”
Second Iteration: 'Townsend Supporters Threw Oreo Cookies' - The same day as Will’s column appears, the Sun and the Associated Press report that Ehrlich told an audience at a Jewish day school that “Townsend supporters at the debate threw Oreo cookies” at Steele. The next day, the Salisbury, Maryland, Daily Times reports that “the Ehrlich campaign” claimed “protesters at the debate threw Oreo cookies at Steele.” The Washington Times reports Ehrlich’s claims on October 29. The Washington Post reports on October 31 that Townsend supporters “mocked” Steele by bringing Oreo cookies to the gubernatorial debate. On November 2, the London Times reports as fact that Steele “was bombarded with Oreo cookies” at the gubernatorial debate. Miller later tells other reporters that, while in attendance at the debate, he saw Steele get hit with the cookies. On November 22, the Capital News Service will report that Steele later “said an Oreo cookie rolled to his feet during the debate.”
Reporter Retracts Claim - But in November 2005, after Steele announces his candidacy for Maryland’s gubernatorial position (see November 2005), Miller will tell a reporter for WTOP news radio, Mark Segraves, that he could not swear in court that anyone actually threw cookies because he did not, in fact, see it happen, though he had reported several times that he witnessed just such events. Times managing editor Fran Coombs will issue a denial that Miller ever spoke to Segraves or anyone else from WTOP, but will confirm that Miller did not, in fact, attend the debate. Coombs will tell WTOP that the Times stands behind its reporting, regardless of whether Miller’s claims are true or not, and will say that the reported Oreo incident is a diversion from the real story of a double standard on racism in the Democratic Party.
Third Iteration: Steele Just Saw 'One or Two' Oreos at His Feet - Steele will tell Segraves that he was never struck by any thrown cookies. “I’ve never claimed that I was hit, no. The one or two that I saw at my feet were there. I just happened to look down and see them,” he will say. By November 15, the Associated Press will report that Ehrlich says “he did not personally see cookies thrown at Steele because he was on stage,” and “said he doesn’t know who might have thrown them.”
Fourth Iteration: Steele Says Oreos 'Tossed in His General Direction' - Around the same time, the Associated Press will also report that, according to Steele, “Oreo cookies were tossed in his general direction as he left the debate at Morgan State University,” including two that “rolled up” next to his shoe. The stories are dramatically different, and quite contradictory. Steele’s November account differs from Schurick’s account and his own previous statements.
Fifth Iteration: Oreos 'Thick in the Air Like Locusts' - In the Sun’s 2005 report, Schurick is quoted as saying: “It was raining Oreos. They were thick in the air like locusts. I was there. It was very real. It wasn’t subtle.” Sometime in late 2002, Ehrlich will tell a radio audience that his father was struck in the head by a cookie, though, according to the WBAL report at the time, “Schurick would not make Robert L. Ehrlich Sr. available for an interview.”
No Mention in Reporting after Debate, No Video Evidence - In November 2005, the Baltimore Sun will report that no newspaper or television reports mentioned any such incident in their initial reporting of the debate, and although four local television stations recorded the debate, no video of any such incident exists.
Eyewitnesses: Nothing Was Thrown - The Sun will report the operations manager of the Murphy Building at Morgan State, Vander Harris, as saying nothing of the sort occurred: “It didn’t happen here,” he will say. “I was in on the cleanup, and we found no cookies or anything else abnormal. There were no Oreo cookies thrown.” Several attendees at the event will tell the Sun that while some disruptive behavior occurred, no one threw anything at Steele nor anyone else. Morgan State spokesman Clint Coleman will say: “There were a lot of things, disturbances, by this group of outsiders who were bent on disrupting the debate. But I never actually saw Oreo cookies being thrown at him.” As for “raining Oreos,” Coleman will say, “I can tell you that did not happen.” Neil Duke, who moderated the event for the NAACP, will say he never saw any cookies thrown at Steele. “Were there some goofballs sitting in [the] right-hand corner section tossing cookies amongst themselves and acting like sophomores, as the legend has it?” Duke will say. “I have no reason to doubt those sources; I just didn’t see it.” And Wayne Frazier, the president of the Maryland-Washington Minority Contractors Association, will say he saw Steele walk into the auditorium that evening, but saw no Oreos. “I was there the whole time and did not see any of the so-called Oreo cookie incident,” he will say. “It could have happened and I didn’t see it, but I was in the auditorium from start to finish.” [WTOP Radio 103.5 (Washington), 11/15/2005; Media Matters, 11/21/2005]

In his weekly radio address, President Bush tells the nation: “The Iraqi regime possesses biological and chemical weapons, is rebuilding the facilities to make more, and, according to the British government, could launch a biological or chemical attack in as little as 45 minutes after the order is given. The regime has long-standing and continuing ties to terrorist groups, and there are al-Qaeda terrorists inside Iraq. This regime is seeking a nuclear bomb, and with fissile material could build one within a year.” Many Americans are shocked and frightened by Bush’s flat litany of assertions. What they do not know is that none of them are true. The CIA had reluctantly agreed to produce a National Intelligence Estimate (NIE) on Iraq less than three weeks before (see September 5, 2002); the result is an NIE packed with half-truths, exaggerations, and outright lies (see October 1, 2002). None of Bush’s statements are supported by hard intelligence, and all will later be disproven. [White House, 9/28/2002; Center for Public Integrity, 1/23/2008] In 2007, author Craig Unger will write that the conflict seems to have gotten personal with Bush. “There’s no doubt [Saddam Hussein’s] hatred is mainly directed against us,” Bush says during the address. “There’s no doubt he can’t stand us. Shortly after the Bali bombings (see October 12, 2002), the Washington Post will report: “US intelligence officials said they intercepted communications in late September [2002] signaling a strike on a Western tourist site. Bali was mentioned in the US intelligence report…” [Washington Post, 10/15/2002] In response to the Post story, the State Department will issue a statement saying they did share this information with the Australian government. The statement admits their warning discussed tourists as potential targets, but says the warning did no specify an attack on Bali on the weekend that it took place. No government urgently warns tourists to stay away from likely targets in Bali before the bombings. Australian Prime Minister John Howard will later admit that Australia received this warning, but he will claim his intelligence agency analyzed it and decided no upgrade in alert status or any special warning was warranted. High-ranking al-Qaeda leader Abd al-Rahim al-Nashiri is captured in the United Arab Emirates (UAE). Al-Nashiri is believed to have played a role in the 1998 African embassy bombings (see 10:35-10:39 a.m., August 7, 1998), attended a 9/11 planning summit in Malaysia in 2000 (see January 5-8, 2000), was one of the masterminds of the 2000 USS Cole bombing (see October 12, 2000), and planned the 2002 bombing of the French oil tanker Limburg (see October 6, 2002). Said to be chief of al-Qaeda’s operations in the Persian Gulf region, he is taking flight lessons in the remote UAE region of Umm Al-Qaiwain when he is arrested by local authorities and then turned over to the CIA. An unknown number of other al-Qaeda suspects are arrested with him, but apparently they are considered less important and are not handed to the CIA as well. Most reports indicate he is arrested on November 8, 2002, about two weeks before the first media leaks about his arrest. [New York Times, 12/23/2002] However, US News and World Report will later claim that he was arrested even earlier, early in October 2002. “Al-Nashiri soon broke; he even let officials listen in as he called his associates.” This leads to intelligence on Qaed Salim Sinan al-Harethi, a top al-Qaeda operative, and the US assassinates him with a missile strike on November 3, 2002, after trailing him for about two weeks (see November 3, 2002). [US News and World Report, 6/2/2003] Al-Nashiri will remain in secret CIA prisons until 2006 and then will be transfered to the Guantanamo Bay prison (see September 2-3, 2006).

The Associated Press reports that Islamist militant leader Abu Musab al-Zarqawi “was in Baghdad about two months ago, and US officials suspect his presence was known to the government of Iraqi President Saddam Hussein, a defense official said…” This anonymous US official also calls al-Zarqawi among al-Qaeda’s top two dozen leaders. The article notes that “some US officials… contend the United States has no solid evidence of Iraq and al-Qaeda working together to conduct terrorist operations.” [Associated Press, 10/2/2002] But despite this caveat, just five days later, in a public speech President Bush mentions “one very senior al-Qaeda leader who received medical treatment in Baghdad this year, and who has been associated with planning for chemical and biological attacks” (see October 7, 2002). This is a reference to al-Zarqawi, and is said to be based on communications intercepts. But the same day as the speech, Knight Ridder Newspapers reports that according to US intelligence officials, “The intercepts provide no evidence that [al-Zarqawi] was working with the Iraqi regime or that he was working on a terrorist operation while he was in Iraq.” [Knight Ridder, 10/7/2002; US President, 10/14/2002] After the US invades Iraq in March 2003, evidence of this Baghdad connection will start to be questioned. Reports that al-Zarqawi was there to have a leg amputated will later be debunked (see January 26, 2003). In June 2003, Newsweek will report, “Bush Administration officials also have acknowledged that their information about al-Zarqawi’s stay in Baghdad is sketchy at best.” [Newsweek, 6/25/2003] Whether al-Zarqawi stayed in Baghdad and if the Hussein government was aware of his movements remains unclear.

The US and Britain continue to demand that weapons inspectors not return to Iraq until after a stronger resolution—one that authorizes the use of force—is agreed upon by the National Security Council. Bush threatens to lead a coalition against Iraq if the UN Security Council fails to back him. During an address in Washington to Hispanic leaders, Bush says: “My intent, of course, is for the United Nations to do its job. I think it’ll make it easier for us to keep the peace…. My intent is to put together a vast coalition of countries who understand the threat of Saddam Hussein. The military option is my last choice, not my first. It’s my last choice…. The choice is up to the United Nations to show its resolve. The choice is up to Saddam Hussein to fulfill its word—his word. And if neither of them acts, the United States, in deliberate fashion, will lead a coalition to take away the world’s worst weapons from one of the world’s worst leaders.” [Reuters, 10/3/2002; US President, 10/7/2002] But Russia, France, and China maintain their opposition to the US-British draft resolution which would pave the way for using military force against Iraq. Russian Deputy Foreign Minister Alexander Saltanov strongly disagrees that a tougher resolution is needed. And France remains insistent that any further resolutions against Iraq should be broken into two parts—one defining the terms of inspections, and a second outlining the consequences if Iraq does not comply. Preparing for a major speech by President Bush on Iraq (see October 7, 2002), the National Security Council has sent the sixth draft of the speech to the CIA for vetting. It includes a line saying that Iraq “has been caught attempting to purchase up to 500 metric tons of uranium oxide from Africa—an essential ingredient in the enrichment process.” It is essentially the same language turned down by the CIA for an earlier speech (see September 11, 2002). In response, the CIA’s associate deputy director for intelligence [ADDI] sends a four-page memo to Bush administration officials, including Bush’s Deputy National Security Adviser, Stephen J. Hadley, and the chief speechwriter, Michael Gerson, expressing doubt over claims that Iraq had attempted to obtain uranium from Niger. On page three of the memo, the ADDI advises removing the allegation from the draft of Bush’s upcoming speech in Cincinnati. “[R]emove the sentence because the amount is in dispute and it is debatable whether it can be acquired from the source. We told Congress that the Brits have exaggerated this issue (see September 24, 2002). Finally, the Iraqis already have 550 metric tons of uranium oxide in their inventory.” [Washington Post, 7/23/2003; Unger, 2007, pp. 261-262] Despite the warning, the White House refuses to make substantial changes. The attack takes places in the Gulf of Aden off the coast of Yemen. One crew member is killed and over 90,000 barrels of oil leak into the sea. The attack is similar to the one on the USS Cole almost two years before (see October 12, 2000) and is planned by one of the same people, Abd al-Rahim al-Nashiri. CIA Director George Tenet sends a letter to Senator Bob Graham (D-FL), the chairman of the Senate Intelligence Committee. In the letter, Tenet acknowledges declassifying some “material available to further the Senate’s forthcoming open debate on a joint resolution concerning Iraq” (see October 7, 2002). Tenet says that the declassified information supports the following contentions:

In 2007, former CIA analyst Valerie Plame Wilson will write that in the weeks and months preceding the invasion of Iraq, “Congress, just like the general public, was being bombarded with dreadful scenarios of what would happen if the perceived imminent threat from Iraq was not stopped in its tracks.” Plame Wilson will note that little strong evidence exists in CIA analyses to support Tenet’s contentions. Senior Bush neoconservatives, angry at the US intelligence community’s refusal to allow the Iraq-Niger uranium deal allegations into President Bush’s Cincinnati speech (see October 5, 2002 and October 6, 2002), begin purging “troublesome” intelligence analysts. One such victim is Bruce Hardcastle (see Early 2002), the DIA’s intelligence officer for the Middle East, South Asia, and Counterterrorism. Hardcastle has challenged Bush officials, telling them “that the way they were handling evidence was wrong.” In retaliation, not only does Hardcastle lose his job, but his position is eliminated entirely. DIA analyst Patrick Lang will later recall: “They wanted just liaison officers who were junior. They didn’t want a senior intelligence officer who argued with them.” Lang will recall Hardcastle saying, “I couldn’t deal with these people.” Lang continues: “They are such ideologues that they know what the outcome should be.… They start with an almost psuedo-religious faith. They wanted the intelligence agencies to produce material to show a threat, particularly an imminent threat. Then they worked back to prove their case. It was the opposite of what the process should have been like, that the evidence should prove the case.” [Unger, 2007, pp. 262-263]

Italian Panorama journalist Elisabetta Burba goes to the US Embassy in Rome and gives US officials copies of the Niger uranium documents (see March 2000) that she had obtained two days before (see Afternoon October 7, 2002). [Agence France-Presse, 7/19/2003; Agence France-Presse, 7/19/2003; Washington Post, 7/20/2003; Associated Press, 7/20/2003; Agence France-Presse, 9/19/2003; New Yorker, 10/27/2003] Up till now, the embassy had only received reports of the documents. [Unger, 2007, pp. 261] It is likely that the so-called “Italian Letter,” a letter purporting to be from the president of Niger to Iraq’s Saddam Hussein confirming the Iraq-Niger uranium deal, is not in the bundle of documents Burba brings to the embassy. [ERiposte, 3/6/2006] Burba meets with the embassy’s press spokesman, Ian Kelly. Over coffee, she tells him that she has documents purporting to show that Iraq has signed a deal to buy uranium from Niger, and she needs his help to confirm their authenticity and accuracy. Kelly brings three others into the discussion—a political officer, one of his own staffers, and perhaps a US military official, as Burba will later recall—and moves the entire group into his office. The subsequent discussion is brief; Burba hands over the documents. Kelly tells her the embassy will look into the matter. The CIA station chief, Jeff Castelli, refuses to meet with Burba. [Washington Post, 4/3/2007] Castelli is told about Burba’s visit, but is not interested. As the CIA’s head of European operations, Tyler Drumheller, will later recall, Castelli says, “This is bullsh_t we don’t have time to waste on.” Castelli receives a copy of the documents but quickly forgets about them. According to Drumheller, Castelli is “not the most organized guy in the world. And his view was, ‘This is the least important thing that’s coming across my desk now.’ He just made a mistake.” [Isikoff and Corn, 2006, pp. 148; CBS News, 4/23/2006] Several newspapers cite sources (mostly unnamed, so it’s possible they are all relying on the same sources) that appear to support Drumheller’s account. [New York Times, 3/23/2003; Washington Post, 7/20/2003; New Yorker, 10/27/2003] For example, an unnamed senior CIA official will tell Knut Royce of Newsday in July of 2003 that the CIA “had serious questions about [the claims] from day one” (see July 21, 2003). The agency “had accounts (see October 15, 2001, February 5, 2002, and March 25, 2002) of them [the letters] and that was close enough. We didn’t take it that seriously to begin with.… We didn’t put a lot of stock in these reports from Niger. We didn’t rush around to get the actual documents.” [Newsday, 7/11/2003] The documents are faxed to the State Department on October 15 (see October 15, 2002), and its intelligence unit will quickly conclude that the papers are probably fakes. The House votes to give President Bush sweeping authorization to use military force against Iraq, on an overwhelming 296-133 vote. One hundred and twenty-six Democrats vote against the bill even though House Minority Leader Richard Gephardt (D-MO) co-authored it. House Majority Leader Dick Armey (R-TX) issues a veiled warning to the president to use his newly granted powers judiciously: “Mr. President, we are about to give you a great trust.” After the bill passes the House, Bush says, “The days of Iraq acting as an outlaw state are coming to an end… [t]he gathering threat of Iraq must be confronted fully and finally.” One of the opponents of the House bill, John Spratt (D-SC), says that without an international diplomatic approach, “this will be the United States versus Iraq and in some quarters the US versus the Arab and the Muslim world.” Commenting on the passing of the resolution, the Washington Post reports: “Yesterday’s debate often lacked the passion and unpredictability of the 1991 affair, when members sat late into the night listening attentively to a war of words. By contrast, the House chamber was largely empty most of yesterday: the arguments familiar, the outcome certain, the conclusion anticlimactic.” [White House, 10/2/2002; PBS, 10/10/2002; Washington Post, 10/11/2002] Bush calls on the Senate to pass the bill (see October 11, 2002) so it can be signed into law as soon as possible (see October 16, 2002). The Senate overwhelmingly approves the resolution the next day. [PBS, 10/10/2002; US Senate, 10/11/2002] The AUMF contains a caveat in the authorization that conditions Congress’s authorization of military force on a formal determination by Bush that Iraq poses a threat to the US that cannot be contained diplomatically, and that any military action against Iraq must be consistent with the war against those who attacked the US on 9/11 (see March 18, 2003). The US media virtually ignores this condition, and therefore the Bush administration does not feel particularly bound by it. Congress asks for the formal declaration either before launching an attack or within 48 hours of the attack, and insists that the declaration contain solid evidence of the impossibility of further diplomacy, and of Iraq’s connection to the 9/11 terrorists. Laskar Jihad, Indonesia’s largest violent Islamist militant group, supposedly disbands itself just hours before the Bali bombings (see October 12, 2002). However, the announcement is not made public until several days after the bombings, so it is unclear if the disbanding took place before or after. The group was formed in 2000 and had as many as 15,000 members. It sent thousands of militants to the Maluku islands to fight Christians, but fighting there has largely died down by this time (see January 1999-July 2001). Several days after the Bali bombings, the group’s legal adviser says the disbanding of the group “has nothing to do with the [Bali] bombs,” adding: “There was no pressure on us from military. The clerics in Indonesia and in the Middle East have disagreed with Jafar Umar Thalib’s teachings and have asked him to disband the group.” Thalib is the leader of the group. [Guardian, 10/15/2002] Several days after the Bali bombings, a Muslim fighter in the Malukus who used to fight with Laskar Jihad, tells CNN: “the group was ordered to disband by rogue military generals to hide the generals’ involvement with the group.… These generals backed Laskar Jihad and they acted on their own, outside of the institution. They are afraid of being found out now that there are so many foreign investigators in Bali.” Curiously, General Djaja Suparman, the general who founded a militia that later morphed into Laskar Jihad, was in Bali with some other high-ranking military leaders in the days just before the Bali bombings. The military confirms he and others were there, but says they were only there to have a vacation. [Asia Times, 11/7/2002] While Laskar Jihad activity is greatly reduced in the Malukus after this time, the group remains active in remote regions of Indonesia. For instance, in March 2005, the Australian television program SBS Dateline will report that Laskar Jihad is active fighting separatists in West Papua, the Indonesian half of the island of New Guinea. A backpack-mounted device carried by a suicide bomber explodes in another Kuta Beach discotheque. 202 people are killed and 209 are injured. Eighty-eight of those killed are Australian, while most of the rest are Indonesian. A much smaller device explodes outside the US consulate in nearby Denpasar, causing only minor damage and no casualties. No group claims responsibility, but Jemaah Islamiyah (JI), al-Qaeda’s main affiliate in Southeast Asia, is believed to be behind the bombings. [New York Times, 10/13/2002; New York Times, 10/14/2002; BBC, 2/19/2003] Hambali, a key leader in both al-Qaeda and JI, is said to have been involved. He will be arrested in 2003 and taken into US custody (see August 12, 2003). [Chicago Tribune, 12/7/2003] Three alleged JI operatives, Ali Gufron (a.k.a. Mukhlas), Imam Samudra, and Amrozi bin Nurhasyim, will be arrested in Indonesia and sentenced to death in 2003 for their roles in the Bali bombings. Ali Imron, brother to both Gufron and Amrozi, will be sentenced to life in prison. [New York Times, 9/19/2003; New York Times, 10/3/2003] JI operatives Dulmatin, Azhari Husin, and Noordin Mohammed Top also are said to have major roles in the bombings. Husin will be killed in a police shootout in 2005, while Dulmatin and Top remain at large (see October 6, 2005 and After). It will later turn out that the US was given a “stunningly explicit and specific” advanced warning that Hambali and JI were planning to attack nightclubs in Bali (see August 21, 2002).

Former ambassador Joseph Wilson, having broken his decade-long silence on Middle Eastern affairs just months before (see May 2002), pens an op-ed for the San Jose Mercury News titled “How Saddam Thinks.” Wilson warns of a “bloody American invasion and long occupation of Iraq” if President Bush follows up on his threats of “regime change,” with the United Nations failing to derail the US push for war with forceful weapons inspections.
Crucial Lessons of Desert Shield/Desert Storm - “Both the US and UN approaches are dangerously flawed,” he warns. “They ignore crucial lessons we learned in the Persian Gulf War about how Saddam thinks.” If Bush does go to war, Wilson writes, “Saddam [Hussein] will use every weapon in his arsenal to defend himself,” which may well include chemical and biological weapons. “But,” he continues, “history also shows that the less-confrontational approach favored by some on the Security Council—France and Russia—isn’t likely to work, either. Saddam has, after all, repeatedly flouted UN resolutions and ignored its demands to let weapons inspectors back into the country for almost four years.” Wilson recalls listening to Hussein gloat over the prospect of slaughtering American soldiers during Desert Shield (see August 6, 1990), and the difficulties Wilson and his fellow diplomats encountered in persuading Hussein to release hundreds of foreign hostages intended for use as “human shields” (see August 8, 1990).
Hussein a 'Malignant Narcissist' - Wilson writes that “[w]e learned firsthand… what the CIA psychiatrists have said for years: Saddam is an egomaniacal sociopath whose penchant for high-risk gambles is exceeded only by a propensity for miscalculation. Those psychiatrists, who study the characters of world leaders, believe that he suffers from what is popularly called ‘malignant narcissism,’ a sense of self-worth that drives him to act in ways that others would deem irrational, such as invading neighboring countries. But the trait also makes him highly sensitive to direct confrontation and embarrassment, even as he is contemptuous of compromise.”
Confrontation without War - Wilson found that a confrontational, “in your face” approach worked the best in getting the desired results from Hussein (see August 8-9, 1990). Wilson recommends revisiting the techniques that worked during the 1991 Gulf War, incorporating “[a]n aggressive UN-sanctioned campaign to disarm Iraq—bolstered by a militarily supported inspection process—would combine the best of the US and UN approaches, a robust disarmament policy with the international legitimacy the United States seeks.” Wilson continues: “Our message to Saddam can be simple: ‘You are going to lose your weapons of mass destruction capability either through the inspections or through a sustained cruise-missile assault on the 700 suspicious sites the United Nations has already identified. If you rebuild them, we will attack again. And if you use weapons of mass destruction or attack another country in the region, we will destroy you and your regime.’ The decision to live or die then becomes his to make. The ultimate lesson of the Gulf War may be that when offered the choice, Saddam will sacrifice almost everything before sacrificing his own life or grip on power.” [Mercury News (San Jose), 10/13/2002]
Response - Foreign Intelligence Advisory Board chief Brent Scowcroft (see October 16, 2001 and March 2002) asks Wilson if he can “take [the editorial] over to the White House.” Scowcroft says that White House officials need to hear the views of someone who actually has experience with Iraq and with Hussein. Days later, Wilson receives a note from former President George H. W. Bush indicating that he agrees wholeheartedly with Wilson’s position. The op-ed will also garner invitations from a variety of television news shows for Wilson to appear as a commentator. [Wilson, 2004, pp. 295-297]

At a Republican fundraiser, President Bush erroneously labels captured Islamic militant Abu Zubaida (see March 28, 2002) as “one of the top three leaders” of al-Qaeda. Senior government officials have long been aware that many intelligence officials believe Zubaida to be little more than a low-level “gofer” for al-Qaeda (see Shortly After March 28, 2002 and April 9, 2002 and After). Bush says, apparently boasting of the deaths of some captured suspects: “I would say we’ve hauled in—arrested, or however you want to put it—a couple of thousand of al-Qaeda. Some of them are former leaders. Abu Zubaida was one of the top three leaders in the organization. Like number weren’t as lucky, they met a different kind of fate. But they’re no longer a problem. We’re slowly but surely rounding them up. The other day we got this guy, [Ramzi b]in al-Shibh. He popped his head up. He’s not a problem (see September 11, 2002). Slowly but surely. And I’m not giving up. There’s not a calendar on my desk that says, okay, on this day, you quit. That’s just not the way I think.” [White House, 10/14/2002]

The US embassy in Rome faxes the Niger documents to the State Department’s Bureau of Nonproliferation, which then passes a copy of the documents to the Bureau of Intelligence and Research (INR), the State Department’s intelligence bureau. [US Congress, 7/7/2004, pp. 58] Simon Dodge, an INR nuclear analyst, receives a copy, and after a brief review of the documents immediately suspects that they are bogus. One particularly strange document that is included in the Niger papers describes a secret meeting that allegedly took place on June 14, 2002 at the home of the Iraqi ambassador in Rome. According to the document, the meeting was attended by military officials from Iraq, Iran, Sudan, Libya, and Pakistan. The purpose of the meeting was to form a coalition of Islamic nations against the West. They would seek “Global Support,” which would include backing from the “Islamic patriots accused of belonging to criminal organizations.” Dodge finds the scenario depicted in the document “completely implausible.” He notices that the document bears the same official seal that is stamped on the Niger documents. He concludes that the documents are probably all fakes, and he sends an email to other analysts in the intelligence community explaining this conclusion. [US Congress, 7/7/2004, pp. 58; Isikoff and Corn, 2006, pp. 162; CBS News, 4/23/2006] According to one unnamed CIA official, “Everybody knew at every step of the way that they were false—until they got to the Pentagon, where they were believed.” [New Yorker, 10/27/2003] Copies also go to nuclear experts at the DIA, the Department of Energy, and the NSA. Wayne White, the deputy director of the INR and the INR’s principal Iraq analyst, reviews the documents himself. Within 15 minutes he too begins doubting their authenticity (see Mid-October 2002). Munir Alibabic.Munir Alibabic. [Source: Dani]By 2002, the Muslim Bosnian government is controlled by the Social Democrats, now that Alija Izetbegovic has retired and his SDA party is out of power. To deal with the issues of corruption and terrorism, in July 2002 the new government brings Munir Alibabic out of retirement to run Bosnia’s intelligence agency. Alibabic had been fired in 1994 as head of the secret police in Sarajevo for opposing government corruption and the support of the mujaheddin, and he is widely respected for his integrity. He vows to stop the cover-up of Bosnian Muslim ties to terrorism, stating, “A crime is a crime, regardless which side commits it.” He works aggressively with other intelligence agencies to uncover the al-Qaeda network in Bosnia. He soon completes a report detailing ties between the SDA party and organized crime. The report names Elfatih Hassanein, Hasan Cengic, Irfan Ljevakovic, Bakir Alispahic, and Alija Delimustafic as key co-consiprators. The first three were central figures in the Third World Relief Agency (TWRA), a bin Laden-linked charity front active in the early 1990s (see Mid-1991-1996). But in October 2002 elections, the SDA returns to power. Paddy Ashdown, a British politician serving as the Office of the High Representative in Bosnia, publicly supported the SDA over secularists and reformers in the election and shortly after they win he fires Alibabic. Author John Schindler will later write that “By the end of 2002, it was evident that the post-9/11 drive to run al-Qaeda out of Bosnia and force its local supporters to heel had run out of steam.” [Schindler, 2007, pp. 289-291] The Telegraph will later report that Ashdown fired Alibabic on the advice of the British intelligence agency MI6, but it isn’t clear why. In sworn testimony to the 9/11 Congressional Inquiry, CIA Director George Tenet repeatedly claims that a March 2000 cable sent to CIA headquarters reporting that hijacker Nawaf Alhazmi had entered the US was not read by anybody. He says, “I know that nobody read that cable,” “Nobody read that cable in the March timeframe,” and “[N]obody read that information only cable.” [New York Times, 10/17/2002] Former Counterterrorist Center Director Cofer Black will also claim that the cable was not read. [US Congress, 7/24/2003, pp. 51 pdf file] However, a later investigation by the CIA Office of Inspector General will find that numerous CIA officers had actually read the cable shortly after it was sent (see March 6, 2000 and After). Nevertheless, the 9/11 Commission will later assert that, “No-one outside the Counterterrorist Center was told any of this” (about Alhazmi’s arrival in the US) and neglect to mention that Tenet had previously misstated the CIA’s knowledge of the hijackers. German investigators believe they know of nine people who are still living and who played roles in assisting the 9/11 plot, the Chicago Tribune reports. An unnamed senior German intelligence official says he believes these nine cover everyone linked to the al-Qaeda Hamburg cell who helped plan, finance, or carry out the plot. However, he says “there may be people still in Hamburg who had a certain knowledge” of the plot. The nine are:
bullet Ramzi Bin al-Shibh, a Yemeni. He is considered the head of the 9/11 plot in Germany while the hijackers were living in the US. He was captured in Pakistan in 2002 and put in the secret CIA prison system (see September 11, 2002).
bullet Mounir El Motassadeq, a Moroccan. He knew the others in the Hamburg cell and trained in Afghanistan (see May 22 to August 2000). He has been arrested and charged with a role in the 9/11 plot. He will later be convicted (see January 8, 2007).
bullet Abdelghani Mzoudi, a Moroccan. Mzoudi lived with Mohamed Atta and others in the Hamburg cell, and he is alleged to have attended a training camp in Afghanistan in 2000 (see Summer 2000). He has been arrested in Germany and charged with a role in the 9/11 attacks. He will later be acquitted after the US fails to cooperate with German prosecutors (see February 5, 2004-June 8, 2005).
bullet Barakat Yarkas, a Spaniard. He is alleged to be the leader of al-Qaeda in Spain. Germans believe he helped arrange a meeting between Atta and bin al-Shibh in Spain two months before 9/11 (see July 8-19, 2001). He is imprisoned in Spain on various terrorism charges. He will later be convicted to 12 years in prison, but not for any role in 9/11 (see September 26, 2005).
bullet Mohammed Haydar Zammar, a Moroccan. He was investigated for al-Qaeda ties for years prior to 9/11. He was captured in Morocco after 9/11 and renditioned to a prison in Syria (see December 2001).
bullet Said Bahaji, a German. He is said to be a computer expert who taught Atta and others how to use computers to communicate. He fled Germany just before 9/11 (see September 3-5, 2001). There is a warrant for his arrest (see September 21, 2001), but he remains free.
bullet Zakariya Essabar, a Moroccan. He lived with Atta, Bahaji, and others. He trained in Afghanistan and attempted to get a US visa (see January-October 2000). He fled Germany just before 9/11 (see Late August 2001). There is a warrant for his arrest (see October 19, 2001), but he remains free overseas.
bullet Mamoun Darkazanli, a Syrian. He had been investigated for al-Qaeda ties for years before 9/11 (see 1993), and he knew Atta, Marwan Alshehhi, and other members of the Hamburg cell (see October 9, 1999). He remains free in Germany (see November 11, 2010).
bullet Abdul-Matin Tatari, a Syrian. He runs a textile company called Tatex Trading that investigators suspect helped get money and visas for al-Qaeda operatives (see September 10, 2002-June 2003). More than Just Nine - But a few months later, the Chicago Tribune will report that investigators believe there are many more members of the Hamburg cell than was previously reported (see February 25, 2003). For instance, one likely participant who will only become publicly known many years later is Naamen Meziche. He was friends with Atta and others in the Hamburg cell, and he will be killed by a US drone strike in Pakistan in 2010 (see October 5, 2010).

Peter Jennings reports on ABC News’ World News Tonight, “The FBI tells ABC News it is very confident that it has found the person responsible” for the 2001 anthrax attacks (see October 5-November 21, 2001). Reporter Brian Ross explains, “That’s right, Peter, Steven Hatfill. And while there’s no direct evidence, authorities say they are building what they describe as a growing case of circumstantial evidence.” [Salon, 8/10/2008] In 2008, Hatfill will be exonerated and given a large cash settlement after a federal judge states there “is not a scintilla of evidence” linking him to the anthrax attacks (see June 27, 2008).

[Source: PBS]A report is made publicly available, which the Engineering News-Record calls the “most comprehensive study yet on the destruction of the World Trade Center.” The study was commissioned by WTC leaseholder Silverstein Properties Inc. to support a $7 billion insurance claim, and conducted by a team of engineers from several leading firms, including Weidlinger Associates, LZA Technology/Thornton-Tomasetti, and ARUPFire. It is intended to build on a previous study sponsored by FEMA (see May 1, 2002). The report’s findings are based on an analysis of original structural drawings, thousands of photos, and dozens of videos. Investigators used fire evaluation techniques and powerful computer software to simulate the condition of each tower at critical times between the planes’ impacts and the towers’ collapses. The earlier FEMA investigators had no access to such computer modeling. Matthys Levy, the chairman of Weidlinger Associates and one of the engineers on the study team, says, “The buildings had tremendous reserve capacity and that was reflected in all of the elements we analyzed. In fact, because there were so much excess capacity, the columns even in the impact floors did not buckle immediately, but failed as the result of the fire.” The report states that failure of the WTC’s steel floor supports (“trusses”) did not contribute to the collapses. Instead, the collapses were caused by the failure of steel structural columns that were either destroyed when the planes hit or lost fireproofing, leaving them vulnerable to the weakening effects of the ensuing fires. It says that debris and dust distributed by the plane crashes inhibited the fires, such that the average air temperatures on the impact floors were between 400 and 700°C (750-1,300°F): significantly lower than those associated with typical “fully developed” office fires. However, says Matthys Levy, “By the time the temperature inside the buildings reached 400 degrees, the steel would have lost approximately 50% of its strength. Eventually, gravity took over and the towers began to fall.” Then, according to the analysis led by researchers from LZA Technology/Thornton-Tomasetti, “Once collapse initiated in each tower, essentially all of the interior structure of the tower fell straight down with floors pancaking on top of one another. The network of perimeter steel columns and spandrels acted like a chute to funnel the interior contents into the tower footprint.” According to the computer simulations, the damage to the South Tower’s steel core columns was so severe that the tower should have collapsed immediately after the plane hit. Civil engineer John Osteraas says this incorrect result casts doubt upon some of the study’s predictions. The report concludes that the collapse of the South Tower did not cause or contribute to the subsequent collapse of the North Tower, thus supporting Silverstein Properties’ claim that the terrorist attack represented two occurrences, entitling it to two $3.5 billion insurance policy limits. A separate study commissioned by the insurers contradicts this (see October 23, 2002). The Silverstein report apparently does not examine the collapse of WTC Building 7, a 47-story skyscraper that also collapsed on 9/11 (see (5:20 p.m.) September 11, 2001). It has been passed on to the National Institute of Standards and Technology (NIST), which is undertaking its own investigation of the WTC collapses (see August 21, 2002). Concurrent with the New York Times’s revelation of the existence of the Office of Special Plans (OSP—see October 24, 2002), Defense Secretary Donald Rumsfeld announces the existence of a similar operation, the Counter-Terrorism Evaluation Group (CTEG—see Shortly After September 11, 2001). CTEG has been absorbed into the OSP by this point. The Washington Post will call CTEG “a small team of defense officials outside regular intelligence channels to focus on unearthing details about Iraqi ties with al-Qaeda and other terrorist networks.” The unveiling of CTEG coincides with Rumsfeld’s move to take over the financing and management of an outside project, the “Information Collection Project,” sponsored by the Iraqi National Congress and one of CTEG’s primary sources of information. Before now, the State Department had financed and overseen the INC project, and had grown increasingly reluctant to maintain what Defense Intelligence Agency official Patrick Lang later calls an “off the reservation” intelligence operation (see September 15, 2001). Rumsfeld tells reporters, “Any suggestion that [CTEG is] an intelligence-gathering activity or an intelligence unit of some sort, I think would be a misunderstanding of it.” Rumsfeld’s assertion is contradicted by former CIA case officer, enthusiastic neoconservative, and CTEG consultant Reuel Marc Gerecht, who describes the intelligence-gathering mission of CTEG: “The Pentagon is setting up the capability to assess information on Iraq in areas that in the past might have been the realm of the agency (CIA). A Washington Post front page article about the 2001 anthrax attacks (see October 5-November 21, 2001) states, “Bush administration officials have acknowledged that the anthrax attacks were an important motivator in the US decision to confront Iraq, and several senior administration officials say today that they still strongly suspect a foreign source—perhaps Iraq—even though no one has publicly said so.” The rest of the article focuses on the theory that the attacks were so sophisticated that a state such as Iraq was likely responsible (see October 28, 2002). In 2002, microbiologist Perry Mikesell came under suspicion as the anthrax attacker. Mikesell is an anthrax specialist who worked with Bruce Ivins and others at USAMRIID, the US Army’s top bioweapons laboratory, in the 1980s and 1990s. Since then, he had worked at the Battelle Memorial Institute, a private contractor in Ohio working on classified government bioweapons programs. According to family members, he begins drinking heavily after the FBI starts suspecting him, consuming up to a fifth of hard liquor a day. One relative will later say, “It was a shock that all of a sudden he’s a raging alcoholic.” He dies in late October 2002. The relative will say, “He drank himself to death.” His connection to the anthrax investigation will not be revealed until 2008, and it still is completely unknown why the FBI was focusing on him. Two weeks before his suicide (see July 29, 2008), Ivins will liken the pressure he is facing from the FBI to the pressure that had been put on Mikesell. He will reportedly tell a colleague, “Perry [Mikesell] drank himself to death.” [New York Times, 8/9/2008]

Elliott Abrams, a well-known neoconservative and former Iran-Contra figure, leads one of a dozen Bush administration working groups charged with drafting post-invasion plans. Involved in his group are adamant neoconservatives Joe Collins, a deputy assistant secretary at the Pentagon, and Robin Cleveland, a former aide to Republican Sen. Mitch McConnell of Kentucky. His working group is supposed to draft plans for rapid humanitarian planning. But critics in the State Department complain that it involves itself in the issue of post-Saddam politics and economic reconstruction. Abrams’ group is backed by Paul Wolfowitz and the vice president’s office. An ally of Secretary of State Colin Powell tells Insight magazine, “This is a case of stealthy micromanagement by the Wolfowitz hawks—they use what bureaucratic vehicles are available to make their imprint on policy.” Additionally the group is very secretive. It refuses “to brief not only top State Department officials but also aides of Gen. Tommy Franks, the commanding officer of the US Central Command [CENTCOM], about what it is doing.” Instead it stovepipes its work to its contacts in the White House. Sources in the State Department and CIA believe that one of the group’s apparent aims is reducing the influence of the State Department, CIA and the United Nations in post-Saddam Iraq. These critics also question “why a convicted felon [Abrams], pardoned or not, is being allowed to help shape policy.” Within the Pentagon, there is also resentment of Abrams’ group. An unnamed Pentagon source says General Tommy Franks is being “left out of the loop.” A Defense official says, “CENTCOM is for the most part unaware of what Abrams is doing, but friction is developing and the military end of the equation feels that they are being mislead.” [Insight, 11/26/2002; Insight, 12/28/2002]

On November 2, 2002, only three weeks after the 2002 Bali bombings (see October 12, 2002), the Australian and Indonesian teams investigating the attacks say they have finished their initial forensic analysis of the bomb site. One forensic team member says, “We have all we need to nail these bad guys down.” [New York Times, 11/2/2002; Jakarta Post, 1/3/2003] That same day, investigators get their first big break when they discover the vehicle identification number of the chassis of the van used by some of the bombers. [BBC, 12/3/2002] The first arrest of an officially suspected bomber, Amrozi, takes place on November 5. He had bought the van. He immediately confesses to taking part in the bombings. Other arrests, including the arrest of an alleged mastermind of the bombings, Imam Samudra, follow in the next weeks and months. [Jakarta Post, 1/3/2003] Most Balinese are Hindu, and on November 15, the island holds a large public Hindu ritual purifying the bomb sites. The next day, bulldozers begin dumping the debris into the ocean, and they dump all the bomb site wreckage into the ocean over the next several days. Finnegan, editor for the English-language Jakarta Post newspaper, will later sarcastically comment on how quickly the investigators finished their on-site work: “Astounding work, as it must have set a world record for crime scene forensic analysis.” He will also note, “Given the scope of the bombing and the sheer size of the primary and secondary blast areas - where traces from a plethora of different explosive compounds were swabbed from - this was a feat that escaped even the vaunted investigators working the World Trade Center [9/11] crime scene in New York, who spent nearly a year literally sifting by hand for evidence at the site.” [Jakarta Post, 1/3/2003]

Qaed Senyan al-Harethi.Qaed Senyan al-Harethi. [Source: Yemen Observer]A CIA-operated Predator drone fires a missile that destroys a truck of suspected al-Qaeda operatives in Yemen. The target of the attack is Qaed Salim Sinan al-Harethi, a top al-Qaeda operative, but five others are also killed, including American citizen Kamal Derwish. [Washington Post, 11/4/2002; Associated Press, 12/3/2002] Al-Harethi is said to have been involved in the 2000 bombing of the USS Cole. Bush administration officials say Derwish was the ringleader of a sleeper cell in Lackawanna, New York (see September 13, 2002). [Washington Post, 11/9/2002; Newsweek, 11/11/2002] A former high-level intelligence officer complains that Defense Secretary Donald Rumsfeld wants “to take guys out for political effect.” Al-Harethi was being tracked for weeks through his cell phone. [New Yorker, 12/16/2002] The attack happens one day before mid-term elections in the US. Newsweek will note that timing of the strike “was, at the very least, fortuitous” for the Bush administration. [Newsweek, 11/11/2002] New Yorker magazine will later report, “The Yemeni government had planned to delay an announcement of the attack until it could issue a joint statement with Washington. But on November 5, Deputy Defense Secretary Paul Wolfowitz will brag about the strike on CNN, thus ruining the cover story and revealing that the truck was destroyed by a US missile (see November 5, 2002). The UN Security Council unanimously votes 15-0 in favor of UN Resolution 1441, which stipulates that Iraq is required to readmit UN weapons inspectors under tougher terms than required by previous UN resolutions. The resolution does not give the US authority to use force against Iraq. Following six attacks by different radical Islamic groups in Tunisia (see April 11, 2002), Pakistan, Yemen (see October 6, 2002), Kuwait, Bali (see October 12, 2002), and Moscow, a new audio message is released by a man said by some to be Osama bin Laden, although the identity of the speaker will be disputed (see November 29, 2002). The voice on the tape outlines a principle he says he and his allies are using: reciprocity. He comments: “If it pains you to see your victims and your allies’ victims in Tunisia, Karachi, Failaka, and Oman, then remember that our children are murdered daily in Palestine and Iraq… If it pains you to see your victims in Moscow, then remember ours in Chechnya. The release of an audio message by a man thought to be Osama bin Laden (see November 12, 2002) sparks several publications to run stories about the authentication of the voice on the tape. These articles make several points about voice analysis of apparent bin Laden recordings:
bullet Machine analysis: Some aspects of voice identification are done my machine. Voice authentication software measures the acoustic qualities of a person’s voice, such as pitch, loudness, basic resonances, frequency, and amplitude. [New Scientist, 11/13/2002; Slate, 11/15/2002] This produces spectrographic information and can also be used to look for specific features of a voice, such as a nasal quality. In addition, every person creates the same sounds using a slightly different set of basic pitches, so the set of frequencies in bin Laden’s vowels, like those in “ea” from “fear,” will be marginally different from anyone else’s. By examining this frequency detail for every vowel and comparing them to previous examples, a machine analysis can tell if they are the same and were all said by him. [Slate, 11/15/2002] However, “People hardly ever pronounce the same word the same way twice, even in the same utterance,” says Robert Berkovitz, a speech analyst with Sensimetrics Corp. bullet Human analysis: Some aspects of voice identification are done by humans, who are, according to Slate, “very good at doing the kind of thing most people do subconsciously—telling if someone comes from a particular region by recognizing basic vowel and consonant qualities.” For example, a human analyst can tell whether the “Ye” sound in “Yemen” is of the right length and stress for bin Laden’s dialect. [Slate, 11/15/2002] Experts listen to previous recordings of bin Laden, and compare them syllable by syllable. [New Scientist, 11/13/2002; Slate, 11/15/2002] Experts can also verify whether words on a tape generally match those uttered by someone of bin Laden’s age and educational background. bullet Quality of tape: According to Slate, the November tape is “allegedly very noisy and possibly went down a phone line at some point.” [Slate, 11/15/2002] However, the New Scientist reports, “Voice analysis experts say the quality of the recording appears good enough to determine if the recording is genuine.” It also quotes Steve Cain of Forensic Tape Analysis, a company that received snippets of the tape from US media, who says, “It seems like it is at least clear enough and there’s enough amplitude of that unknown speaker’s voice that if you had a known sample of bin Laden it would be possible.” [New Scientist, 11/13/2002]

bullet Uncertainty: The New Scientist quotes Tomi Kinnunnen, an expert in computer analysis of speech at the University of Joensuu, Finland, as saying: “There is always the possibility of error.… But if you have a clean sample with little noise, you can quite reliably say [who it is].” [New Scientist, 11/13/2002] However, according to Slate, human and machine analyses can be “formidable,” but “neither type of analysis can say with 100 percent certainty that the speaker on the tape is bin Laden or anyone else.” [Slate, 11/15/2002] CBS finds that intelligence analysts are convinced the tape is from bin Laden, but “they will never be sure,” because “Computer voice analysis lacks the accuracy of fingerprint or DNA identification and can be hamstrung by a skilled impersonator or low-quality recording.” “You can say with some probability, but you can never be sure,” says Kenneth Stevens, a Massachusetts Institute of Technology expert on speech analysis and synthesis. “Where there’s a combination of strong motivation and relatively weak science, there’s an opportunity for deception,” adds Berkovitz. “You can’t put the voice in a slot and have it come out saying, ‘This is Joe Smith.’” [CBS News, 11/13/2002]

Conservative radio talk show host Rush Limbaugh excoriates Senate Majority Leader Tom Daschle (D-SD), accusing him of attempting to “destroy this country” by questioning the Bush administration’s rationale for war with Iraq (see September 25, 2002 and September 26, 2002). Limbaugh directly impugns Daschle’s patriotism, accusing him of being a traitor and comparing him to “Hanoi Jane” Fonda and World War II’s Japanese propaganda maven, Tokyo Rose. “What more do you want to do to destroy this country than what you’ve already done?” Limbaugh shouts. “It is unconscionable what this man has done! This stuff gets broadcast around the world, Senator. What do you want your nickname to be? Hanoi Tom? Tokyo Tom?… You sit there and pontificate on the fact that we’re not winning the war on terrorism when you and your party have done nothing but try to sabotage it.” One of Limbaugh’s callers accuses Daschle and the Democrats of giving “aid and comfort to the enemy”—a legal definition of treason—and says of Daschle, “He’s not interested in the safety of this country.” [Jamieson and Cappella, 2008, pp. 156-157]

Shortly after his arrest in the United Arab Emirates in early October 2002 (see Early October 2002), al-Qaeda leader Abd al-Rahim al-Nashiri is taken to an unknown location and tortured. He is waterboarded, which is a technique simulating drowning that is widely regarded as torture. He is only one of about three high-ranking detainees waterboarded, according to media reports (see May 2002-2003). [Associated Press, 12/11/2007] Much will later be written about the torture and interrogation of other top al-Qaeda leaders such as Abu Zubaida, but next to nothing is publicly known about what happens to al-Nashiri in the months after his arrest. However, in late 2007 it will be reported that at least some of his interrogations were videotaped by the CIA (see Spring-Late 2002) and his waterboarding was videotaped. [Washington Post, 12/18/2007] But these videotapes will later be destroyed in controversial circumstances (see November 2005). The waterboarding likely takes place in Thailand, because the videotape of al-Nashiri’s torture will be destroyed there in 2005 (see November 2005). [Newsweek, 6/28/2008]

Senate Majority Leader Tom Daschle (D-SD) responds to conservative radio host Rush Limbaugh’s accusations that Daschle and Congressional Democrats are guilty of treason by not supporting the Bush administration’s push for war with Iraq (see November 15, 2002). Daschle calls Limbaugh “and all of the Rush Limbaugh wannabees” of having “a shrill edge,” and says of his listeners: “They want to act because they get emotionally invested. And so, you know, the threats to us in public life go up dramatically (see October 5-November 21, 2001), and on our families and on us in a way that’s very disconcerting. You know, we see it in foreign countries. And we think, well my God, how can this religious fundamentalism become so violent? Well, it’s the same shrill rhetoric. It’s that same shrill power that motivates. They—you know, they—that somebody says something, and then it becomes a little more shrill the next time, and then more shrill the next time.” Some media observers, such as the Washington Post’s Howard Kurtz, later say that such responses from their political targets merely elevate figures such as Limbaugh in their listeners’ eyes. The CIA’s office of the inspector general begins an investigation of the killing of detainee Gul Rahman at the agency’s Salt Pit black site in Afghanistan (see November 20, 2002). The investigation begins after the agency’s inspector general, John Helgerson, is notified of the incident by management (see Shortly After November 20, 2002). It is unclear whether the inspector general issues a separate report on this incident or whether his office’s conclusions about it are contained in a general report on the effectiveness of the CIA’s detention and interrogation program (see May 7, 2004). Whatever the case, the inspector general’s conclusions focus on two agency officials, an officer named Matthew Zirbel, who caused Rahman’s death, and his boss, the CIA’s station chief in Afghanistan, known only as Paul P. The investigation finds that Zirbel displayed poor judgement in leaving Rahman to die, but that he made repeated requests for guidance that were largely ignored. [Associated Press, 3/28/2010]

The new commander at the Guantanamo detention facility, General Geoffrey Miller, receives a “voco”—a vocal command—to begin aggressively interrogating suspected “20th hijacker” Mohamed al-Khatani (see August 8, 2002-January 15, 2003). This is well before Defense Secretary Donald Rumsfeld gives written authorization for these techniques to be used (see November 27, 2002 and December 2, 2002), but after the request had been submitted for approval (see October 11, 2002). Considering Miller’s rank, it seems unlikely that anyone lower in the chain of command than Rumsfeld would have issued the order, and Rumsfeld is unlikely to make such a “voco” without the support of Pentagon general counsel William J. Haynes. The interrogation log of al-Khatani for November 23 indicates the immediate effect of the “voco”: “The detainee arrives at the interrogation booth. His hood is removed and he is bolted to the floor.” [Vanity Fair, 5/2008]

Unprecedented Access - Woodward, who made his reputation uncovering the Watergate conspiracy from 30 years before (see June 15, 1974), is no longer an unknown young reporter working to find sources that will confide in him. Now he is an established Washington insider. For this book, Woodward was granted “unprecedented access” to Bush administration officials, including notes from National Security Council meetings and two long interviews with President Bush himself, far more access than even that granted to the 9/11 Commission and Congressional inquiries into other events of interest. Former Republican House Speaker Newt Gingrich will find this level of access inexplicable, saying that “it makes no sense for an administration that has jealously guarded its executive privilege to allow a reporter the access it denies to members of Congress.”
Hagiographic Account - The Observer’s Peter Preston calls Woodward’s book a “more-or-less instant study of the White House after 9/11,” and writes that while Woodward could have created “a classic of investigative journalism,” instead he gave us a compendium of “painful, obsessively useless detail” that generally paints the picture the White House wants painted. If Woodward’s book is to be believed, Preston writes, the Colin Powell moderates and the Dick Cheney hawks “had their snappy moments, but they’re OK-ish now.” CIA Director George Tenet “is a far-sighted man” who not only immediately divined that Osama bin Laden was behind the attacks, but while the towers were still burning, wondered if the attacks had anything to do with “that guy taking pilot training,” Zacarias Moussaoui. Iraq war planner General Tommy Franks usually feels “finer than the hair on a frog’s back.” Former President Clinton’s “weak-willed men used to ‘pound the desert’ ineffectually, while his brilliant successors like to hit something, if at all possible.” And President Bush “is bright and talented and eloquent and decisive,” who runs National Security Council meetings himself and knows all he needs to know about the state of the world (Woodward quotes Bush as saying, “I’m not a textbook player—I’m a gut player”). Both Preston and author Frank Rich accuse Woodward of “burnishing” Bush’s image at the expense of the truth. A few potentially embarrassing tidbits manage to poke their way through what both Preston and Rich call the “hagiography,” mostly relating to senior administration officials’ lack of knowledge about Afghan tribal politics and the lack of evidence tying Saddam Hussein to the 9/11 attacks. But all told, the book seems to tell a clear story: where Clinton was indecisive, Bush is forthright; where Clinton muddled around with bin Laden and Middle East terrorism, Bush is taking the war straight into the heart of the Islamist redoubt. [Observer, 12/1/2002; Rich, 2006, pp. 66-67] The book gives such a favorable impression of Bush and his administration that the Republican National Committee will recommend it on its Web site. Selective Reporting - The administration officials who talked to Woodward are painted in largely glowing terms, while those who did not (including Attorney General John Ashcroft and Homeland Security head Tom Ridge) are, in Preston’s words, “written out of the script.” Potentially embarrassing incidents such as the administration’s complete failure to find the source of the anthrax mailings of 2001 (see September 17-18, 2001 and October 5-November 21, 2001) and the ineffective roundup of thousands of Middle Eastern “terror suspects” after 9/11 (see Late November, 2001) are ignored entirely. The pivotal Afghan battle of Tora Bora, where bin Laden was allowed to escape US clutches (see Mid-November 2001-Mid-December 2001), gets two paragraphs. [Observer, 12/1/2002; Rich, 2006, pp. 66-67] Guardian reviewer Peter Symon notes that Woodward even fails to ask the most “obvious questions” about the 9/11 attacks, instead accepting the administration’s accounts of events and its responses as absolute and unquestionable. [Guardian, 1/29/2003] Rich notes that Woodward grants Bush and his officials tremendous individual credence, taking their word on one issue after another without question: for example, when Bush calls investigative journalist Seymour Hersh “a liar,” Woodward takes Bush’s word without giving Hersh a chance to respond. More generally, Woodward never asks the obvious follow-up questions. Bush explains why the US didn’t attack Afghanistan and Iraq simultaneously after the 9/11 attacks: “If we tried to do too many things… militarily, then… the lack of focus would have been a huge risk.” Rich notes, “The follow-up question that was not to be found in Bush at War was simple enough: If it was a huge risk to split our focus between Saddam and al-Qaeda then, why wasn’t it now?” Preston concludes: “Maybe the Woodward of three decades ago would have given [the Bush administration more intense scrutiny]. No longer. Today’s Woodward, eight bestsellers later, skates breathlessly from interview to interview and notepad to notepad without ever, seemingly, stopping to think, ‘Why am I being told all this? What does it mean?’ It isn’t investigation, just cross-referenced compilation.” [Observer, 12/1/2002; Rich, 2006, pp. 66-67]

The authenticity of a new audio tape purportedly made by bin Laden, in which he praises recent attacks in Bali, Kuwait, Yemen and Moscow (see November 12, 2002), is disputed by Swiss voice analysts. US officials believe the voice is “almost certainly” bin Laden, but the Dalle Molle Institute for Perceptual Artificial Intelligence in Switzerland, one of the world’s leading voice-recognition institutes, is 95 percent certain the tape is a forgery. [BBC, 11/13/2002; BBC, 11/18/2002; BBC, 11/29/2002; Toronto Star, 12/16/2002] Two weeks after it was broadcast, a British newspaper publishes the complete text of a “letter to the American people,” purportedly written by bin Laden. David Brant, the head of the Naval Criminal Investigative Service (NCIS), learns disturbing information about detainees in US custody being abused at the Guantanamo detention facility. Brant is in charge of a team of NCIS agents working with the FBI at Guantanamo, called the Criminal Investigative Task Force. The task force’s job is to obtain incriminating information from the detainees for use in future trials or tribunals. Brant, an experienced law enforcement officer, finds what his task force agents tell him about interrogations at Guantanamo troubling. According to his agents, who have examined the interrogation logs, the military intelligence interrogators seem poorly trained and frustrated by their lack of success. Brant learns that the interrogators are engaging in ever-escalating levels of physical and psychological abuse, using tactics that Brant will later describe as “repugnant.” Much of his information comes from NCIS psychologist Michael Gelles, who has access to the Army’s top-secret interrogation logs at Guantanamo. [New Yorker, 2/27/2006; Vanity Fair, 5/2008] Gelles learned of the torture techniques being used at Guantanamo while reading through those logs for an internal study. He is taken aback at what author and reporter Charlie Savage will later call “a meticulously bureaucratic, minute-by-minute account of physical torments and degradation being inflicted on prisoners by American servicemen and women.” [Savage, 2007, pp. 178] Brant will later recall that Gelles “is phenomenal at unlocking the minds of everyone from child abusers to terrorists.” Therefore, when Gelles tells Brant that he finds the logs “shocking,” Brant takes it seriously. One of the most horrific cases is that of Mohamed al-Khatani (see December 17, 2002). [New Yorker, 2/27/2006; Vanity Fair, 5/2008] Brant says that NCIS will pull its interrogators out of Guantanamo if the abuses continue, and goes to the Navy’s general counsel, Alberto Mora, for help (see December 17-18, 2002). [Source: Kuantanutama.com]The International Crisis Group (ICG), an international think tank, publishes a report that identifies a “curious link” between the al-Qaeda affiliate group Jemaah Islamiyah (JI) and the Indonesian military, the TNI. [International Crisis Group, 12/11/2002] PBS Frontline will later say that Sidney Jones, the author of the report, “is widely considered to know more about terrorism in Indonesia than anyone.” [PBS Frontline, 4/2007] The ICG says the connection is “strong enough to raise the question of how much the TNI knew about Jemaah Islamiah” before the October 2002 Bali bombings. The report outs Fauzi Hasbi, a long-time JI leader, as an Indonesian government mole. It says that Hasbi has maintained links with Major-General Syafrie Syamsuddin since the late 1970s. “Hasbi maintains regular communication with Major-General Syafrie Syamsuddin to this day and is known to be close to the National Intelligence Agency head Hendropriyono.” Furthermore, an army intelligence officer interviewed by ICG had Hasbi’s number programmed into his cell phone, and actually called Hasbi and spoke to him while in the presence of the ICG investigator. And remarkably, Hasbi himself has claimed that he has treated Hambali, a top JI and al-Qaeda leader believed to have masterminded the 2002 Bali bombings, like a son. Hasbi and Hambali lived next door to each other in a small Malaysian village until late 2000 (see April 1991-Late 2000). [International Crisis Group, 12/11/2002; Age (Melbourne), 12/12/2002] Hasbi is killed in mysterious circumstances two months later (see 1979-February 22, 2003).

[Source: Associated Press]During a several day search of a pond near Frederick, Maryland, by FBI investigators for clues to the anthrax attacks (see October 5-November 21, 2001), Scientist Bruce Ivins is there with the investigators, working as a Red Cross volunteer. Ivins will commit suicide in 2008 after coming under scrutiny as the FBI’s main suspect in the anthrax attacks (see July 29, 2008). The pond search is highly publicized at the time, and is an unsuccessful effort to find evidence connecting the attacks to Steven Hatfill, the FBI’s main suspect at the time (see December 12-17, 2002). The pond is near USAMRIID, the US Army’s top bioweapons laboratory where Ivins works and Hatfill used to work. As a Red Cross volunteer, Ivins serves coffee, donuts, and snacks to FBI agents and other investigators in a military tent. He is eventually removed after officials realize he is an anthrax researcher who could compromise the investigation. Apparently, Ivins is a regular Red Cross volunteer at the time. Miriam Fleming, another Red Cross volunteer working at the pond search, will later recall that Ivins “was kind of goofy, but he was always in a good mood. He seemed so normal.” [New York Times, 8/7/2008]

Henry Kissinger resigns as head of the new 9/11 Commission. [New York Times, 12/12/2002] However, the Congressional Research Service insists that he does, and Kissinger resigns rather than reveal his clients. [MSNBC, 12/13/2002; Seattle Times, 12/14/2002]
Spilled Coffee - Kissinger had also been pressured to reveal his client list at a meeting with a group of victims’ relatives, in particular the “Jersey Girls.” One of the “Girls,” Lorie Van Auken, had even asked Kissinger whether he had “any clients named bin Laden?” Kissinger, who was pouring coffee at that moment, refused to answer, but spilled the coffee and fell off the sofa on which he was sitting. [Shenon, 2008, pp. 12-3]
Business Ties - It is reported that Kissinger is (or has been) a consultant for Unocal, the oil corporation, and was involved in plans to build pipelines through Afghanistan (see September-October 1995). [Washington Post, 10/5/1998; Salon, 12/3/2002] Kissinger claims he did no current work for any oil companies or Mideast clients, but several corporations with heavy investments in Saudi Arabia, such as ABB Group, a Swiss-Swedish engineering firm, and Boeing Corp., pay him consulting fees of at least $250,000 a year. A Boeing spokesman said its “long-standing” relationship with Kissinger involved advice on deals in East Asia, not Saudi Arabia. Boeing sold $7.2 billion worth of aircraft to Saudi Arabia in 1995. Not Vetted - In a surprising break from usual procedures regarding high-profile presidential appointments, White House lawyers never vetted Kissinger for conflicts of interest. [Newsweek, 12/15/2002] The Washington Post says that after the resignations of Kissinger and Mitchell, the commission “has lost time” and “is in disarray, which is no small trick given that it has yet to meet.” [Washington Post, 12/14/2002]

[Source: C-SPAN]The 10 members of the new 9/11 Commission are appointed by this date, and are: Republicans Thomas Kean (chairman), Slade Gorton, James Thompson, Fred Fielding, and John Lehman, and Democrats Lee Hamilton (vice chairman), Max Cleland, Tim Roemer, Richard Ben-Veniste, and Jamie Gorelick. [Chicago Tribune, 12/12/2002; Associated Press, 12/16/2002; New York Times, 12/17/2002] Senators Richard Shelby (R-AL) and John McCain (R-AZ) had a say in the choice of one of the Republican positions. They and many 9/11 victims’ relatives wanted former Senator Warren Rudman (R-NH), who co-wrote an acclaimed report about terrorism before 9/11 (see January 31, 2001). But, possibly under pressure from the White House, Senate Republican leader Trent Lott (R-MS) blocked Rudman’s appointment and chose John Lehman instead. [St. Petersburg Times, 12/12/2002; Associated Press, 12/13/2002; Reuters, 12/16/2002; Shenon, 2008, pp. 55-56] It will slowly emerge over the next several months that at least six of the 10 commissioners have ties to the airline industry. [CBS News, 3/5/2003] Henry Kissinger (see December 13, 2002) and his replacement Thomas Kean (see December 16, 2002) both caused controversy when they were named. In addition, the other nine members of the Commission are later shown to all have potential conflicts of interest. Republican commissioners:

bullet Richard Ben-Veniste represents Boeing and United Airlines. [CBS News, 3/5/2003] He also has other curious connections, according to a 2001 book on CIA ties to drug running written by Daniel Hopsicker, which has an entire chapter called “Who is Richard Ben-Veniste?” Lawyer Ben-Veniste, Hopsicker says, “has made a career of defending political crooks, specializing in cases that involve drugs and politics.” He has been referred to in print as a “Mob lawyer,” and was a long-time lawyer for Barry Seal, one of the most famous drug dealers in US history who is also alleged to have had CIA connections. David Brant, the head of the Naval Criminal Investigative Service (NCIS), approaches Naval General Counsel Alberto Mora about the abuse of detainees in US custody at Guantanamo, abuse perhaps authorized at a “high level” in Washington. Brant is in charge of a team of NCIS agents working with the FBI at Guantanamo, called the Criminal Investigative Task Force. The task force’s job is to obtain incriminating information from the detainees for use in future trials or tribunals.
Troubling Information - Brant has learned troubling information about the interrogations at Guantanamo (see Early December, 2002). Brant had never discussed anything so sensitive with Mora before, and later recalls, “I wasn’t sure how he would react.” Brant had already discussed the allegations of abuse with Army officials, since they have command authority over the detainees, and to Air Force officials as well, but goes to Mora after deciding that no one in either branch seems to care. He is not hopeful that Mora will feel any differently.
Worried about Abuse - Brant goes to Mora because, he will recall, he didn’t want his investigators to “in any way observe, condone, or participate in any level of physical or in-depth psychological abuse. No slapping, deprivation of water, heat, dogs, psychological abuse. It was pretty basic, black and white to me.… I didn’t know or care what the rules were that had been set by the Department of Defense at that point. We were going to do what was morally, ethically, and legally permissible.” Brant had ordered his task force members to “stand clear and report” any abusive tactics that they might witness.
Mora 'Rocked' - Brant is not disappointed in Mora’s reactions. A military official who works closely with Brant will later recall that the news “rocked” Mora. The official will add that Mora “was visionary about this,” adding, “He quickly grasped the fact that these techniques in the hands of people with this little training spelled disaster.” Brant asks if Mora wants to hear more about the situation; Mora will write in a 2004 memo (see July 7, 2004), “I responded that I felt I had to.”
Second Meeting - Brant meets with Mora the next day, and shows Mora part of the transcript of the [Mohamed al-Khatani] interrogations. Mora is shocked when Brant tells him that the abuse was not “rogue activity,” but apparently sanctioned by the highest levels in the Bush administration. Mora will write in his memo, “I was under the opinion that the interrogation activities described would be unlawful and unworthy of the military services.” Mora will recall in a 2006 interview: “I was appalled by the whole thing. It was clearly abusive, and it was clearly contrary to everything we were ever taught about American values.” Shocked, Mora will learn more from his counterpart in the Army (see December 18, 2002), and determine that the abusive practices need to be terminated.
Meeting with Pentagon Lawyer - He will bring his concerns to the Pentagon’s general counsel, William J. Haynes, and will leave that meeting hopeful that Haynes will put an end to the extreme measures being used at Guantanamo (see December 20, 2002). But when Mora returns from Christmas vacation, he will learn that Haynes has done nothing. Mora will continue to argue against the torture of detainees (see Early January, 2003). Ghassan Elashi holds a press conference and denies any connection to terrorist funding.Ghassan Elashi holds a press conference and denies any connection to terrorist funding. [Source: Associated Press]Mousa Abu Marzouk, his wife, and five brothers (Ghassan Elashi, Bayan Elashi, Hazim Elashi, Basman Elashi, and Ihsan Elashi) are charged with conspiracy, money laundering, dealing in the property of a designated terrorist, illegal export, and making false statements. The brothers are arrested in Texas, but Marzouk and his wife are living in Syria and remain free. Marzouk is considered a top leader of Hamas. FBI agent Robert Wright had been investigating Marzouk and the brothers since the late 1990s. Wright is set to appear on ABC News on December 19, 2002, to complain that the FBI had failed to prosecute Marzouk for years. As the New York Post notes, “That got results: A day before the show aired, Attorney General Ashcroft announced he would indict Marzouk.” [BBC, 12/18/2002; Associated Press, 12/18/2002; Washington Post, 12/19/2002; New York Post, 7/14/2004] FBI agent John Vincent, who worked closely with Wright, comments, “From within the FBI, [Wright] and I tried to get the FBI to use existing criminal laws to attack the infrastructure of terrorist organizations within the United States, but to no avail. It took an appearance [on television] by [Wright] and I to propel them into making arrests that they could have made as early as 1993.” [Federal News Service, 6/2/2003] ABC News similarly notes, “Marzouk was in US custody in 1997 and under criminal investigation then for much the same crimes cited today.” [ABC News, 12/18/2002] Ghassan Elashi was the vice president of InfoCom Corporation, which was raided on September 5, 2001 (see September 5-8, 2001). He was also chairman of Holy Land Foundation, which was shut down in December 2001. InfoCom and Holy Land were based in the same Texas office park and shared many of the same employees. [Guardian, 9/10/2001; CBS News, 12/18/2002; Associated Press, 12/23/2002] Holy Land raised $13 million in 2000 and claimed to be the largest Muslim charity in the US. The government charges that Hamas members met with Ghassan Elsashi and other Holy Land officials in 1993 to discuss raising money for the families of suicide bombers (see October 1993). Wright had begun an investigation into Holy Land that same year, but he faced obstacles from higher-ups and eventually his investigation was shut down. [CBS News, 12/18/2002; New York Times, 7/28/2004] In 2004, the five Elashi brothers will be convicted of selling computer equipment overseas in violation of anti-terrorism laws. In 2005, three of the brothers, Ghassan, Basman, and Bayan Elashi, will be found guilty of supporting Hamas by giving money to Mazouk through 2001. [BBC, 7/8/2004; Associated Press, 4/13/2005] In July 2004, Ghassan Elashi will be charged again, along with four other former Holy Land officials. Two other Holy Land officials will also charged but not arrested, since they had recently left the country. Sen. Charles Schumer (D-NY) will state: “I wonder why this prosecution has taken so long. I think until recently we have not put the resources needed into tracking groups that finance terrorism, and the fact that they didn’t get 24-hour surveillance on these two who escaped is galling and perplexing.” [New York Times, 7/28/2004] In 2007, this court case will result in a mistrial, and be cast as a major setback for the Justice Department (see October 19, 2007).

After experiencing some problems at its inception due to the resignation of its chair and vice-chair (see December 11, 2002 and December 13, 2002), the 9/11 Commission spends much of the next four months hiring staff, getting security clearances (see March 27, 2003), finding office space, and asking for a budget increase (see March 26, 2003). One of the first employees hired is executive director Philip Zelikow, but disputes within the Commission over who will be general council last until March, when Dan Marcus is hired. The Commission is unable to even have a telephone until February, when it finds an official security facility for its offices, and until then the cell phone of staffer Stephanie Kaplan is used as the commission’s initial operations center. However, most of the Commission’s staff cannot then enter their offices, because they do not have the relevant security clearances yet, even though there are no secret documents actually in the offices at this point. Author Philip Shenon will comment: “The commission’s early logistical problems were more than a little humiliating to men like [commission Chairman Tom] Kean and [Vice Chairman Lee] Hamilton, who had commanded vast staffs and virtually unlimited office space during their years in power in government. In early 2003, the Treasury Department draws up a list of 300 individuals, charities, and corporations in Southeast Asia believed to be funding al-Qaeda and its suspected Indonesian affiliate Jemaah Islamiya. “Due to inter-agency politics, the list [is] winnowed down to 18 individuals and 10 companies.” [Contemporary Southeast Asia, 8/1/2003] Later, the number of suspected financiers is narrowed down even further, and on September 5, 2003, only 10 individuals, all connected to Jemaah Islamiya, have their assets frozen. [Associated Press, 9/5/2003] The assets of Jemaah Islamiya itself were frozen shortly after the October 2002 Bali bombings was blamed on the group (see October 12, 2002), though ties between the group and al-Qaeda were first publicly reported in January 2002. [Associated Press, 1/18/2002; United Press International, 1/25/2003] Hambali, a notorious leader of both al-Qaeda’s Southeast Asia operations and Jemaah Islamiya, only had his assets frozen in January 2003, even though he was publicly mentioned as a major figure as far back as January 2001. The CIA’s Deputy Director for Operations, James Pavitt, asks the agency’s office of inspector general, headed by John Helgerson, to investigate allegations that a high-value detainee, Abd al-Rahim al-Nashiri, has been abused. Apparently, Pavitt has just learned of the abuse of al-Nashiri, who was captured in October or November the previous year (see Early October 2002). [Central Intelligence Agency, 5/7/2004, pp. 1-2 pdf file] The abuse took place at a black site in Poland and was apparently carried out by a CIA officer known only as “Albert,” with the approval of his superior, “Mike.” [Central Intelligence Agency, 5/7/2004, pp. 1-2 pdf file; Associated Press, 9/7/2010] The inspector general will issue a report on the incidents later in the year (see October 29, 2003).

bullet She says that her husband lived with Serhane Abdelmajid Fakhet for a month in December 2002. Mustapha Maymouni, Fakhet’s brother-in-law, visited as well. They moved when they felt they were suspected by police.
bullet She saw her husband open several boxes and noticed they contained books and videos about Osama bin Laden.
bullet Her husband and his brother, Moutaz Almallah, strongly suspect their phones are being monitored. Moutaz lives in London but frequently visits Spain (see August 2002).
bullet She describes four particularly important meetings held in her apartment beginning in November 2002. Moutaz and Mouhannad Almallah, Fakhet, and Mayoumi attended all the meetings. Basel Ghalyoun attended the fourth one. In these meetings, they always speak of attack and jihad. They talk about bin Laden, but refer to him as “Emir.”

Police apparently take her warnings seriously because they begin monitoring her apartment in March 2003 (see January 17, 2003-Late March 2004). Most of these people—Fakhet, el-Azizi, Ghalyoun, and both Almallah brothers—are already under surveillance (see December 2001-June 2002). The International Atomic Energy Agency (IAEA) submits a preliminary report to the UN Security Council on the results of the inspections so far. The report says: “To date, no new information of significance has emerged regarding Iraq’s past nuclear program (pre-1991) or with regard to Iraq activities during the period between 1991 and 1998…. [N]o evidence of ongoing prohibited nuclear or nuclear-related activities has been detected, although not all of the laboratory results of sample analysis are yet available.” [Reuters, 1/9/2003; International Atomic Energy Agency, 1/9/2003; New York Times, 1/10/2003; Independent, 1/10/2003; Guardian, 1/10/2003] It also states that Washington’s claim that the aluminum tubes were meant for a centrifuge is highly unlikely. In one section of the report, its authors write: “While the matter is still under investigation and further verification is foreseen, the IAEA’s analysis to date indicates that the specifications of the aluminum tubes sought by Iraq in 2001 and 2002 appear to be consistent with reverse engineering of rockets. While it would be possible to modify such tubes for the manufacture of centrifuges, they are not directly suitable for it.” [Reuters, 1/9/2003; International Atomic Energy Agency, 1/9/2003; New York Times, 1/10/2003; Independent, 1/10/2003; Guardian, 1/10/2003] The IAEA preliminary conclusion on the tubes stems from a visit by inspectors to a metal fabrication factory in Nasser where they had found 13,000 completed rockets, all produced from 7075-T6 aluminum tubes. Iraqi engineers working at the facility explained that they had been seeking more aluminum tubes at the time US authorities intercepted the July 2001 shipment (see July 2001) because their supply was low. The engineers provided additional information which supported the view that the tubes were not meant for use in a gas centrifuge. They told the inspectors that the rigid specifications for the tubes were intended to improve the rocket’s accuracy without requiring any major changes to the design. Documents reviewed by the inspectors confirmed the Iraqi engineers’ account. It was also explained that the tubes, which were stored outside, were anodized so they would not corrode. Inspectors confirmed this also. [New York Times, 10/3/2004]

Beginning around January 2003, Spanish authorities discover that a group of Islamist militants living in Madrid are committing a variety of crimes. Barakat Yarkas, the head of the al-Qaeda cell in Madrid, was arrested with some associates in November 2001 (see November 13, 2001) and this group is largely led by other associates who were not arrested then (see November 13, 2001). Police learn members of this group are creating false passports for other militants, and stealing cars and selling them in Morocco to raise money for their militant activities. [El Mundo (Madrid), 8/10/2005] A number of them are drug dealers. For instance, Jamal Ahmidan, who begins associating with Serhane Abdelmajid Fakhet and many of the other militants in 2003, leads a group of about six drug dealers. For example, in December 2003, Ahmidan shoots someone in the leg for failing to pay for the drugs he had given him. And mere days before the 2004 Madrid train bombings (see 7:37-7:42 a.m., March 11, 2004), he flies to the Spanish island of Mallorca to organize a sale of hashish and Ecstasy. Three of the seven men who blow themselves up in April 2003 with Fakhet and Ahmidan are believed to be drug dealers as well (see 9:05 p.m., April 3, 2004). [Los Angeles Times, 5/23/2004; El Mundo (Madrid), 2/12/2006; New York Times Magazine, 11/25/2007] In fact, Spanish authorities have observed militants committing various crimes to fund their activities since 1995, but they continue to merely gather intelligence and none of them are ever arrested for these crimes (see Late 1995 and After). This pattern continues, and none of the militants will be arrested for obvious criminal activity until after they commit the Madrid bombings.

They might be hiding some computer studies or R. and D. on one single centrifuge. These are not enough to make weapons. There were reports from different member states that Iraq was importing aluminum tubes for enrichment, that they were importing uranium from Africa. Our provisional conclusion is that these tubes were for rockets and not for centrifuges. They deny they have imported any uranium since 1991.” [Time, 1/12/2003]

The British Defense Intelligence Staff Agency (DIS) completes a classified study which concludes that Saddam Hussein and Bin Laden’s earlier attempts to collaborate had “foundered” due to ideological differences. The report says: “While there have been contacts between al-Qaeda and the regime in the past, it is assessed that any fledgling relationship foundered due to mistrust and incompatible ideology.” Osama bin Laden’s objectives, notes the report, are “in ideological conflict with present day Iraq.” The top secret report is sent to Prime Minister Tony Blair and other senior members of his government. Beginning on January 17, 2003, Spanish police begin monitoring an apartment on Virgen de Coro street in Madrid owned by the brothers Moutaz and Mouhannad Almallah. Moutaz owns it but lives in London, so Mouhannad is the landlord and works there every day as well. Police were tipped off about the house earlier in the month by Mouhannad’s estranged wife. She revealed that a group of Islamist militants are regularly meeting there (see January 4, 2003). [El Mundo (Madrid), 8/10/2005] Both Almallah brothers ties to known al-Qaeda figures such as Barakat Yarkas and radical imam Abu Qatada, and Moutaz moved to London in August 2002 to live with Qatada (see August 2002). In 2007, an unnamed Spanish police officer testifying in the Madrid bombings trial will give details about the surveillance of the apartment. He will call it an important place for both meetings and recruitment. The police note that both brothers travel frequently to and from London and also regularly call London. These calls are usually followed by calls to the Middle East or North Africa. Police are aware that Moutaz has no job in London and is in the circle of people around Abu Qatada (although Abu Qatada himself was arrested in late 2002 see (see October 23, 2002)). Basel Ghalyoun and Fouad el Morabit live at the apartment and frequently meet there with Mouhannad Almallah and Serhane Abdelmajid Fakhet. [El Mundo (Madrid), 3/21/2007] Ghalyoun will later admit that in early 2003, Fakhet began to “talk of carrying out an attack in Spain, making jihad…” He will say that others attending jihad meetings at the apartment in 2003 include Arish Rifaat and Rabei Osman Sayed Ahmed. [El Mundo (Madrid), 10/15/2005] Mohammed Larbi ben Sellam is also frequently seen there. [El Mundo (Madrid), 9/28/2004] The surveillance intensifies in subsequent months, and soon the apartment is monitored with video as well (see Spring 2003 and After). Police will keep watching the apartment until arrests are made after the March 2004 Madrid train bombings (see 7:37-7:42 a.m., March 11, 2004). Rifaat, Fakret, and others will allegedly blow themselves up shortly after the Madrid bombings (see 9:05 p.m., April 3, 2004). There are allegations Fakret was an informant (see Shortly After October 2003). Mouhannad Almallah, Ghalyoun, ben Sellam, and el Morabit will be convicted in 2007 and each sentenced to 12 years for roles in the bombings (see October 31, 2007). Ahmed will be convicted of different charges in Italy (see October 31, 2007). Curiously, when the apartment is raided shortly after the Madrid bombings, two documents belonging to police officer Ayman Maussili Kalaji will be found inside. Kalaji will admit to having a friendship with Moutaz Almallah dating back at least to 1995 (see May 16, 2005).

Sometime after Joe Turner’s presentation to IAEA scientists, US analysts collect and photograph tubes in Iraq that are “virtually identical” to the Medusa tubes made in Italy. The tubes even have a stamped logo of the rocket’s Italian manufacturer and the words, “81mm rocket.” This is reported by the Washington Post on January 24: “The quantity and specifications of the tubes—narrow, silver cylinders measuring 81 millimeters in diameter and about a meter in length—made them ill-suited to enrich uranium without extensive modification, the experts said. But they are a perfect fit for a well-documented 81mm conventional rocket program in place for two decades. Iraq imported the same aluminum tubes for rockets in the 1980s. The Navy’s general counsel, Alberto Mora, is shocked when he reads a legal opinion drafted by John Yoo, of the Justice Department’s Office of Legal Counsel, about techniques that can be used in prisoner interrogations (see January 9, 2002). Mora has been fighting the use of questionable techniques and was part of a working group that was reviewing them (see January 15-22, 2003). The opinion was sought by Pentagon general counsel William J. Haynes and not only counters every legal and moral argument Mora has brought to bear, but supersedes the working group. Only one copy of the opinion exists, kept in the office of the Air Force’s general counsel, Mary Walker, the head of the working group.
'Catastrophically Poor Legal Reasoning' - Mora reads it in Walker’s office with mounting horror. The opinion says nothing about prohibiting cruel, degrading, and inhuman treatment of detainees; in fact, it defends such tactics. While sophisticated, it displays “catastrophically poor legal reasoning,” he will later recall. Mora believes that it approaches the level of the notorious Supreme Court decision in Korematsu v. United States, the 1944 decision that upheld the government’s detention of innocent Japanese-Americans during World War II. Mora is not aware that Yoo, like Haynes, is a member of an informal but extremely powerful “inner circle” dominated by David Addington, the chief of staff for Vice President Cheney. In fact, Yoo and Haynes are regular racquetball partners. Like Addington and Cheney, Yoo believes in virtually unrestricted executive powers during a time of war. Yoo wrote that almost any interrogation methods used against terror suspects is legally permissible, an argument that shocks Mora.
Mora's Response - In his June 2004 memo on the subject (see July 7, 2004), Mora will write, “The memo espoused an extreme and virtually unlimited theory of the extent of the President’s Commander-in-Chief authority.” Yoo’s reasoning is “profoundly in error,” Mora concludes, and is “clearly at variance with applicable law.” In 2006, Mora will add, “If everything is permissible, and almost nothing is prohibited, it makes a mockery of the law.” He writes to Walker shortly thereafter, saying that not only is Yoo’s opinion “fundamentally in error” but “dangerous,” because it has the weight of law and can only be reversed by the Attorney General or the President. Walker writes back that she disagrees, and she believes Haynes does as well. Two weeks later, Mora will discuss the memo with Yoo (see February 6, 2003). [New Yorker, 2/27/2006]

Cheney’s chief of staff, I. Lewis Libby, presents the latest draft of a paper that is meant to serve as a rebuttal to Iraq’s December 7 declaration (see February 5, 2003) to Condoleezza Rice, Stephen Hadley, Paul Wolfowitz, Karl Rove, Richard Armitage, Michael Gerson, and Karen Hughes. The paper, written with the help of John Hannah, is supposed to serve as the basis for the speech Secretary of State Colin Powell will deliver to the UN Security Council on February 5 (see February 5, 2003). In his presentation, Libby says that intercepts and human intelligence reports indicate that Saddam Hussein has been attempting to conceal items. He doesn’t know what items are being hidden by the Iraqis, but he says it must be weapons of mass destruction. He also claims that Iraq has extensive ties to al-Qaeda, and cites the alleged meeting between Mohamed Atta and an Iraqi Intelligence agent (see April 8, 2001) as one example. While Armitage is disappointed with Libby’s presentation, Wolfowitz and Rove seem impressed. Karen Hughes warns Libby not to stretch the facts. [Source: Ali Haider / EPA / Corbis]On January 26, 2003, Newsweek reports that in 2002, Islamist militant leader Abu Musab al-Zarqawi “supposedly went to Baghdad, where doctors amputated his leg (injured in Afghan fighting) and replaced it with a prosthesis.” Newsweek also claims that al-Zarqawi “is supposed to be one of al-Qaeda’s top experts on chemical and biological weapons” and that he also met with “Hezbollah militants” and “Iranian secret agents.” This new account builds on previous reports claiming that al-Zarqawi was in Baghdad for some unspecified medical treatment (see October 2, 2002). The article does note, “Not surprisingly, reports putting al-Zarqawi in Iraq piqued the interest of Pentagon hard-liners eager to find evidence to support their suspicion that Saddam [Hussein] and bin Laden are allied and may have plotted 9/11 together. But neither the CIA nor Britain’s legendary MI6 put much stock in al-Zarqawi’s alleged Iraqi visits, stressing such reports are ‘unconfirmed.’” [Newsweek, 1/26/2003] Despite these caveats, it soon will be widely reported that al-Zarqawi had a leg amputated in Baghdad, with at least the tacit knowledge of the Iraqi government. For instance, several days later, USA Today reports, “To those who operate with and against the shadowy al-Zarqawi, including the Kurds of northern Iraq, he is called ‘the man with the limp.’ That is a reference to a poorly fitting artificial limb that replaced a leg amputated in Baghdad last August.” [USA Today, 2/5/2003] And Secretary of State Colin Powell will claim in his February 5, 2003 presentation to the United Nations that al-Zarqawi went to Baghdad in May 2002 for medical treatment and stayed two months (see February 5, 2003). But in October 2004, Knight Ridder will report, based on a new CIA report (see October 4, 2004), “Al-Zarqawi originally was reported to have had a leg amputated, a claim that officials now acknowledge was incorrect.” [Knight Ridder, 10/4/2004] In early 2006, al-Zarqawi will be seen walking in a videotape, clearly in possession of both his legs. And when he is killed later that year, x-rays of his dead body will show a fracture of his right lower leg, but apparently that was caused by the blast that killed him. The station chief explains that the German intelligence service does not consider Curveball a reliable source and that it has been unable to confirm the defector’s statements. “[T]o use information from another liaison service’s source whose information cannot be verified on such an important, key topic should take the most serious consideration,” the station chief writes. Retired General Norman Schwarzkopf, the commander of US forces during the 1991 Gulf War (see January 16, 1991 and After), says he is worried about the “cockiness” of the US war plans for Iraq. Schwarzkopf has already warned that the US must forge broader multinational alliances if it plans to invade and occupy Iraq with any reasonable expectation of success (see August 18, 2002). He adds that his active-duty friends are preoccupied by “the Rumsfeld thing,” the perception that Defense Secretary Donald Rumsfeld has little regard for their judgment. [Roberts, 2008, pp. 141]

[US President, 2/3/2003] An empty seat is left open to symbolize the lives lost during the 9/11 attacks. Author Craig Unger will later characterize Bush’s delivery as somber and effective. He will be interrupted some 70 times by thunderous applause from the assembled lawmakers in the House chambers. One of his biggest applause lines is his statement about the US’s war on “international terrorism:” “The war goes on, and we are winning.” [Unger, 2007, pp. 269-270]
African Uranium - He says: “The British government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa. Saddam Hussein has not credibly explained these activities.… He clearly has much to hide.” [US President, 2/3/2003; White House, 4/18/2003; Independent, 6/5/2003] The British allegation cited by Bush concerns a SISMI (Italy’s military intelligence) report (see Mid-October 2001) based on a set of forged documents. Months after the speech, with evidence mounting that the statement was completely false, the administration will retract this claim (see 3:09 p.m. July 11, 2003).
Aluminum Tubes - Bush alleges that a shipment of aluminum tubes imported by Iraq was intended to be used in the country’s alleged nuclear weapons program. “Our intelligence sources tell us that he has attempted to purchase high-strength aluminum tubes suitable for nuclear weapons production. Saddam Hussein has not credibly explained these activities. He clearly has much to hide.” [US President, 2/3/2003]
Biological Agents - Bush lists a parade of agents: “anthrax, botulinum toxin, Ebola, and plague,” many of which Iraq has never been accused of possessing, and warns against “outlaw regimes that seek and possess nuclear, chemical, and builogical weapons… blackmail, terror, and mass murder.” He then moves from the general to the specific, accusing Iraq of having enough material “to produce over 25,000 liters of anthrax—enough doses to kill several million people… more than 38,000 liters of botulinum toxin—enough to subject millions of people to death by respiratory failure… as much as 500 tons of sarin, mustard and VX nerve agent.” [US President, 2/3/2003; Unger, 2007, pp. 270-271]
False Testimony from Iraqi Scientists - Bush alleges: “Iraqi intelligence officers are posing as the scientists inspectors are supposed to interview. Real scientists have been coached by Iraqi officials on what to say.” [US President, 2/3/2003] But Hans Blix, the chief UNMOVIC weapons inspector, tells the New York Times in an interview that he knows of no evidence supporting this claim. [New York Times, 1/31/2003]
Defector Allegations - Bush, citing intelligence provided by “three Iraqi defectors,” says, “We know that Iraq, in the late 1990s, had several mobile weapons labs… designed to produce germ warfare agents and can be moved from place to a place to evade inspectors.” One of the defectors referred to by Bush is ‘Curveball,’ whom the CIA station chief in Germany warned was not reliable the day before (see January 27, 2003). German intelligence officials watching Bush’s speech are “shocked.” One official later recalls: “Mein Gott! We had always told them it was not proven.… It was not hard intelligence.” [Los Angeles Times, 11/20/2005] Another source for the claim was Mohammad Harith, whom the Defense Intelligence Agency had labeled a “fabricator” the previous May (see May 2002).
Torture, Murder, and 9/11 - Bush accuses Iraqi dictator Saddam Hussein of routinely torturing his own people, using such techniques as “electric shock, burning with hot irons, dripping acid on the skin, mutilation with electric drills, cutting out tongues, and rape.” He then connects Hussein, the torturer, murderer, and terrorist supporter, to the 9/11 attacks, saying: “[I]magine those 19 hijackers with other weapons and other plans—this time armed by Saddam Hussein. It would take one vial, one canister, one crate slipped into this country to bring a day of horror like none we have ever known.” He invites “all free nations” to join him in ensuring no such attack ever happens, but notes that “the course of this nation does not depend on the decisions of others.” After another long burst of applause, Bush continues, “Whatever action is required, whatever action is necessary, I will defend the freedom and security of the American people.” [Unger, 2007, pp. 270-271]
'Direct Personal Threat' - Bush states what former ambassador Joseph Wilson later writes can only be interpreted by Hussein “as a direct personal threat,” saying: “Tonight I have a message for the brave and oppressed people of Iraq: Your enemy is not surrounding your country, your enemy is ruling your country. And the day he and his regime are removed from power will be the day of your liberation.” Wilson will later write: “Not simply promising the disarmament of Iraq as he had in his recent speeches, the president now stated outright his intention to rout Saddam from power, and to kill or capture him. It was an unwise thing to say. It made whatever strategy we adopted for Iraq that much more dangerous because it so blatantly telegraphed our next move and our ultimate goal.” [US President, 2/3/2003; Wilson, 2004, pp. 315]
Defending America - To America’s soldiers, he says: “Many of you are assembling in or near the Middle East, and some crucial hours lay ahead. In these hours, the success of our cause will depend on you. Your training has prepared you. Your honor will guide you. You believe in America, and America believes in you.” In 2007, Unger will write: “A few years earlier, Bush had confided that he thought to be a great president meant being a great commander in chief. Now George W. Bush was leading his nation into war.” [Unger, 2007, pp. 270-271]

One government official will later recall in an interview with the Los Angeles Times that French experts considered Bush’s claim, which he attributed to the British, as “totally crazy because, in our view, there was no backup for this.” Notwithstanding, the French launch another investigation (see Late April or Early May 2002-June 2002) and again, find no evidence supporting the US and British claim. Former Ambassador Joseph Wilson attempts to contact the White House through his contacts in the State Department and Senate with the message that it needs to correct the record on Iraq, specifically the allegation Bush recently made that Iraq sought uranium from Africa (see 9:01 pm January 28, 2003). Wilson had been sent to Niger nearly a year before by the CIA to investigate these claims (see February 21, 2002-March 4, 2002). Both he and the current US ambassador in Niger confirmed that the country’s uranium supplies were under the complete control of a French consortium and that it would have been impossible for Niger to divert uranium to Iraq. Wilson also tells his contacts about General Carlton W. Fulford Jr’s trip (see February 24, 2002) to Niger. On that trip the four-star Marine Corps general had similarly reported to Washington that the purported uranium deal was probably not true. Richard Reid is sentenced to 80 years in prison and fined over $2,000,000 for his attempt to blow up a transatlantic airliner with explosives hidden in his shoe (see December 22, 2001). During the sentencing, Reid plays to the gallery in the court, declaring himself a “soldier of Islam,” admitting allegiance to Osama bin Laden, and accusing the US of killing millions in Iraq. This leads to a confrontation with the judge and a row in the court, and Reid has to be wrestled out of the courtroom. Authors Sean O’Neill and Daniel McGrory will comment, “it is not clear how the judge thought the penniless Reid would ever pay [the fine].” Reid had previously pleaded guilty, meaning that the sentencing was not preceded by a trial, and details of the plot remain unknown. [Source: CBS News]Secretary of State Colin Powell, preparing for his critically important presentation to the United Nations that will assert the reality of Saddam Hussein’s weapons of mass destruction (see February 5, 2003), sends his chief of staff, Larry Wilkerson, to the CIA to prepare for the presentation. CIA Director George Tenet and his experts regale Wilkerson with the information about mobile bioweapons labs provided by the Iraqi defector Curveball (see November 1999). In 2007, Wilkerson will recall, “They presented it in a very dynamic, dramatic, ‘we know this is accurate,’ way.” Curveball’s assertion that he is a firsthand witness is very important, Wilkerson will say. “This was a man who had actually been in the belly of the beast. He had been in the lab. He had been there when an accident occurred. He’d seen people killed. And the implication was, strong implication, that they weren’t killed because of the accident in the explosion, they were killed because they were contaminated. Yes, the source was very credible. As it was presented by the CIA.” Wilkerson later says that both he and Powell accept the claims because they depend on the intelligence community for good information: “And you depend on the director of central intelligence to assimilate all the intelligence community’s input and give it to you.” Wilkerson feels the section on mobile bioweapons is the strongest part of the presentation, as does Powell. With war against Iraq imminent, numerous media outlets finally begin reporting on PNAC’s role in influencing Iraq policy specifically, and US foreign policy generally. PNAC’s plans for global domination had been noted before 9/11 [Washington Post, 8/21/2001] , and PNAC’s 2000 report (see September 2000) recommending the conquest of Iraq even if Saddam Hussein is not in power was first reported in September 2002 [Sunday Herald (Glasgow), 9/7/2002] , but there are few follow-up mentions until February 2003. (Exceptions: [Atlanta Journal-Constitution, 9/29/2002; Bangor Daily News, 10/18/2002; New Statesman, 12/16/2002; Los Angeles Times, 1/12/2003] ) Many of these articles use PNAC to suggest that global and regional domination is the real reason for the Iraq war. Coverage increases as war gets nearer, but many media outlets still fail to do any reporting on this, and some of the reporting that is done is not prominently placed (a New York Times article on the topic is buried in the Arts section! [New York Times, 3/11/2003] ). One Newsweek editorial notes that “not until the last few days” before war have many reasons against the war been brought up. It calls this “too little, too late” to make an impact. The British government releases a dossier titled “Iraq: Its Infrastructure of Concealment, Deception, and Intimidation.” The government says the dossier is based on high-level intelligence and diplomatic sources and was produced with the approval of Prime Minister Tony Blair; it also wins praise from US Secretary of State Colin Powell (see February 7, 2003). Unfortunately, the dossier is almost wholly plagiarized from a September 2002 article by university student Ibrahim al-Marashi. [Middle East Review of International Affairs, 2/23/2003] Al-Marashi was doing postgraduate work at Oxford University when he wrote it. [International Policy Fellowships, 10/1/2006] The article is entitled “Iraq’s Security and Intelligence Network: A Guide and Analysis,” and was published in the Middle East Review of International Affairs Journal (MERIA). [Middle East Review of International Affairs, 2/23/2003] The British dossier plagiarizes two other articles as well, both from Jane’s Intelligence Review (see February 8, 2003), some of which were published as far back as 1997. MERIA is based in Israel, which even moderate Arabs say makes it a suspect source, and all the more reason why the origin of the information should have been cited. [Guardian, 2/7/2003] MERIA, an Internet-based magazine with about 10,000 subscribers, is edited by Jerusalem Post columnist Barry Rubin. [Jerusalem Post, 2/8/2003] Rubin will responds dryly: “We are pleased that the high quality of MERIA Journal’s articles has made them so valuable to our readers.… As noted on the masthead of each issue and all our publications, however, we do appreciate being given credit.” [Middle East Review of International Affairs, 2/23/2003] Al-Marashi, currently working at California’s Center for Nonproliferation Studies, describes himself as an opponent of Saddam Hussein’s regime: “As an Iraqi, I support regime change in Iraq,” he says. Article Used Information from 1991 - He examined Iraq’s secret police and other, similar forces in detail, using captured Iraqi documents from the 1991 Gulf War and updating that information to be more timely. [Middle East Review of International Affairs, 9/2002] The dossier contains entire sections from al-Marashi’s article quoted almost verbatim, including typographical errors contained in the original. When asked about the plagiarism, al-Marashi says he was not approached by the British government for permission to use his work. “It was a shock to me,” he says. Chris Aaron, editor of Jane’s Intelligence Review, says he had not been asked for permission to use material from his article in the dossier. The dossier uses the three articles to detail methods used by the Iraqi government to block and misdirect UN weapons inspectors’ attempts to locate weapons stockpiles in Iraq. The dossier claims that while the UN only has 108 weapons inspectors inside Iraq, the Iraqi government has 20,000 intelligence officers “engaged in disrupting their inspections and concealing weapons of mass destruction.” The dossier claims that every hotel room and telephone used by the weapons inspectors is bugged, and that WMD-related documents are being concealed in Iraqi hospitals, mosques, and homes. Powell will cite the dossier as part of his presentation to the UN detailing evidence of Iraqi weapons programs (see February 5, 2003). [Associated Press, 2/6/2003; BBC, 2/7/2003] When the media exposes the origins of the dossier, Blair officials will concede that they should have been more honest about the source material (see February 6, 2003).
British 'Inflated' Some Numbers, Used More Extreme Language - Al-Marashi, who learns of the plagiarism from a colleague, Glen Rangwala (see February 5, 2003), says the dossier is accurate despite “a few minor cosmetic changes.” He adds: “The only inaccuracies in the [British] document were that they maybe inflated some of the numbers of these intelligence agencies. The primary documents I used for this article are a collection of two sets of documents, one taken from Kurdish rebels in the north of Iraq—around four million documents—as well as 300,000 documents left by Iraqi security services in Kuwait.” [BBC, 2/7/2003] Al-Marashi and Rangwala both note that the dossier uses more extreme language. “Being an academic paper, I tried to soften the language” al-Marashi says. “For example, in one of my documents, I said that [the Iraqi intelligence agency known as the Mukhabarat] support[s] organizations in what Iraq considers hostile regimes, whereas the [British] document refers to it as ‘supporting terrorist organizations in hostile regimes.’” [Guardian, 2/7/2003; New York Times, 2/8/2003]
Third Attempt to Pass Off Old Information as New Evidence - This is the third time in recent months that Downing Street has tried to pass off old, suspect information as damning evidence against Iraq. In September, it released a 50-page dossier, “Iraq’s Weapons of Mass Destruction: The Assessment of the British Government,” that used years-old information from the Foreign Office and British intelligence to make its case (see September 24, 2002); UN inspectors and British journalists visited some of the “facilities of concern” and found nothing (see September 24, 2002). In December, Downing Street released a 23-page report, “Saddam Hussein: Crimes and Human Rights Abuses,” that was heavily criticized by human rights groups, members of Parliament, and others for reusing old information. When that dossier was released, the Foreign Office put forward an Iraqi exile who had been jailed by Hussein for 11 years. The exile displayed handcuffs he said had been placed on him while in captivity. Afterwards, the exile admitted that the handcuffs were actually British in origin. [Guardian, 2/7/2003]
Dossier Product of Heated Debate - The Observer writes of the current “dodgy dossier” that discussions between Blair’s head of strategic communications, Alastair Campbell, foreign policy adviser David Manning, senior intelligence officials, and the new head of British homeland security, David Omand, resulted in a decision to “repeat a wheeze from last autumn: publishing a dossier of ‘intelligence-based evidence,’” this time focusing on Iraq’s history of deceiving weapons inspectors. The dossier had to be released before chief UN inspector Hans Blix could make his scheduled report in mid-February. The previous dossier, about Iraq’s dismal human rights record, had led to what The Observer calls “several stand-up rows between Omand and Campbell, with the former accusing the latter of sprinkling too much ‘magic dust’ over the facts to spice it up for public consumption.” That dossier left “the more sensationalist elements” in the forward, but for this dossier, “there was no time for such niceties. Led by Campbell, a team from the Coalition Information Center—the group set up by Campbell and his American counterpart during the war on the Taliban—began collecting published information that touched on useful themes.” Al-Marashi’s work became the central piece for the cut-and-pasted dossier, which The Observer says was compiled so sloppily that, in using the al-Marashi report and one of the Jane’s articles, two different organizations were confused with one another. Deputy Secretary of State Richard Armitage tells Congress that the Bush administration will engage in diplomatic negotiations with North Korea over its nuclear ambitions (see Mid-January 2003). “Of course we’re going to have direct talks with the North Koreans,” he says, the only question is when and how. President Bush repudiates Armitage’s statement, reportedly becoming so furious that he bans his staff from discussing the entire subject of bilateral talks in public. The administration’s policy continues to be a direct refusal to talk to North Korea. Its explanation: the Clinton administration had negotiated the Agreed Framework with the North Koreans (see October 21, 1994), and that agreement had failed. The Framework had actually been negotiated through the efforts of South Korea and Japan along with the US, and for almost nine years has succeeded in stopping North Korea’s plutonium weapons program from developing, the entire point of the agreement (see December 12, 2002). However, a North Korean uranium bomb project is progressing (see June 2002). In 2008, author J. Peter Scoblic will write: “[T]he administration’s disinclination to engage in bilateral talks seemed more morally than tactically motivated. Conservatives within the administration had realized that, while they could not stop any and all talks with the North, they could prevent bilateral talks and, just as important, they could restrict the latitude given to American negotiators—again, much as [neoconservative defense official Richard] Perle had done during the Reagan administration (see September 1981 through November 1983 and October 11-12, 1986)—so that little or no progress would be made.” [Scoblic, 2008, pp. 240]

Around midnight, CIA Director George Tenet calls CIA official Tyler Drumheller at home and asks for the phone number of Richard Dearlove, the British intelligence chief. Tenet wants to get Dearlove’s approval to use British intelligence in Secretary of State Colin Powell’s speech to the UN (see February 5, 2003). Drumheller takes the opportunity to remind Tenet that the source for the alleged mobile labs, Curveball, is not reliable. “Hey, boss, you’re not going to use that stuff in the speech… ? There are real problems with that,” Drumheller asks. Tenet, distracted and tired, tells him not to worry. It is a connection that has unfolded, that we’re learning more about as we are able to take the testimony of detainees, people who were high up in the al-Qaeda organization. [US Department of State, 2/5/2003] At the insistence of Powell, CIA Director George Tenet is seated directly behind him to the right. “It was theater, a device to signal to the world that Powell was relying on the CIA to make his case that Iraq had weapons of mass destruction,” Vanity Fair magazine will later explain. [Bamford, 2004, pp. 371-2; Vanity Fair, 5/2004, pp. 232] In his speech before the Council, Powell makes the case that Iraq is in further material breach of past UN resolutions, specifically the most recent one, UN Resolution 1441 (see November 8, 2002). Sources cited in Powell’s presentation include defectors, informants, communication intercepts, procurement records, photographs, and detainees. [US Department of State, 2/5/2003] Most of the allegations made by Powell are later demonstrated to be false. “The defectors and other sources went unidentified,” the Associated Press will later report. “The audiotapes were uncorroborated, as were the photo interpretations. No other supporting documents were presented. Little was independently verifiable.” [Associated Press, 8/9/2003]
Iraq's December 7 Declaration Was Inaccurate - Powell contends that Iraq’s December 7 declaration was not complete. According to UN Resolution 1441 the document was supposed to be a “currently accurate, full and complete declaration of all aspects” of its programs to develop weapons of mass destruction. But Saddam has not done this, says Powell, who explains that Iraq has yet to provide sufficient evidence that it destroyed its previously declared stock of 8,500 liters of anthrax, as it claimed in the declaration. Furthermore, notes the secretary of state, UNSCOM inspectors had previously estimated that Iraq possessed the raw materials to produce as much as 25,000 liters of the virus. Iraq Has Ties to Al-Qaeda - Powell repeats earlier claims that Saddam Hussein’s government has ties to al-Qaeda. Powell focuses on the cases of the militant Islamic group Ansar-al-Islam and Abu Musab Zarqawi, a Jordanian-born Palestinian, who had received medical treatment in Baghdad during the summer of 2002 (see December 2001-Mid-2002). [US Department of State, 2/5/2003] However, just days before Powell’s speech, US and British intelligence officials—speaking on condition of anonymity—told the press that the administration’s allegations of Iraqi-al-Qaeda ties were based on information provided by Kurdish groups, who, as enemies of Ansar-al-Islam, should not be considered reliable. Furthermore, these sources unequivocally stated that intelligence analysts on both sides of the Atlantic remained unconvinced of the purported links between Iraq and al-Qaeda (see February 3-4, 2003). [Independent, 2/3/2003; Daily Telegraph, 2/4/2003] Powell also claims that Iraq provided “chemical or biological weapons training for two al-Qaeda associates beginning in December 2000.” The claim is based on a September 2002 CIA document which had warned that its sources were of “varying reliability” and that the claim was not substantiated (see September 2002). The report’s main source, Ibn al-Shaykh al-Libi, an al-Qaeda operative who offered the information to CIA interrogators while in custody, later recounts the claim (see February 14, 2004). [CNN, 9/26/2002; New York Times, 7/31/2004; Newsweek, 7/5/2005] Larry Wilkerson, Powell’s chief of staff, will later say that neither he nor Powell ever received “any dissent with respect to those lines… indeed the entire section that now we know came from [al-Libi].” [Newsweek, 11/10/2005] Senior US officials will admit to the New York Times and Washington Post after the presentation that the administration was not claiming that Saddam Hussein is “exercising operational control” of al-Qaeda. Iraq Has Missiles Capable of Flying Up to 1,200 Kilometers - Describing a photo of the al-Rafah weapons site, Powell says: “As part of this effort, another little piece of evidence, Iraq has built an engine test stand that is larger than anything it has ever had. Notice the dramatic difference in size between the test stand on the left, the old one, and the new one on the right. Note the large exhaust vent. This is where the flame from the engine comes out. The exhaust vent on the right test stand is five times longer than the one on the left. The one of the left is used for short-range missiles. The one on the right is clearly intended for long-range missiles that can fly 1,200 kilometers. This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” [US Department of State, 2/5/2003; New York Times, 2/5/2003] But according to the Associated Press, “… UN missile experts have reported inspecting al-Rafah at least five times since inspections resumed Nov. 27, have studied the specifications of the new test stand, regularly monitor tests at the installation, and thus far have reported no concerns.” [Associated Press, 2/7/2003] Similarly, Reuters quotes Ali Jassem, an Iraqi official, who explains that the large stand referred to in Powell’s speech is not yet in operation and that its larger size is due to the fact that it will be testing engines horizontally. [Reuters, 2/7/2003; Guardian, 2/15/2003] Several days later, Blix will report to the UN that “so far, the test stand has not been associated with a proscribed activity.” [Guardian, 2/15/2003]
Iraqis Attempted to Hide Evidence from Inspectors - Powell shows the UN Security Council satellite shots depicting what he claims are chemical weapons bunkers and convoys of Iraqi cargo trucks preparing to transport ballistic missile components from a weapons site just two days before the arrival of inspectors. “We saw this kind of housecleaning at close to 30 sites,” Powell explains. “We must ask ourselves: Why would Iraq suddenly move equipment of this nature before inspections if they were anxious to demonstrate what they had or did not have?” [US Department of State, 2/5/2003] But the photos are interpreted differently by others. An unnamed UN official and German UN Inspector Peter Franck both say the trucks in the photos are actually fire engines. [Mercury News (San Jose), 3/18/2003; Agence France-Presse, 6/6/2003]
'Literally Removed the Crust of the Earth' - Another series of photos—taken during the spring and summer of 2002—show that Iraqis have removed a layer of topsoil from the al-Musayyib chemical complex. This piece of evidence, combined with information provided by an unnamed source, leads Powell to draw the following conclusion: “The Iraqis literally removed the crust of the earth from large portions of this site in order to conceal chemical weapons evidence that would be there from years of chemical weapons activity.” [US Department of State, 2/5/2003; Washington Post, 2/6/2003] Showing another series of pictures—one taken on November 10 (before inspections) and one taken on December 22—Powell says that a guard station and decontamination truck were removed prior to the arrival of inspectors. Powell does not explain how he knows that the truck in the photograph was a decontamination truck. [US Department of State, 2/5/2003; Washington Post, 2/6/2003; Washington Post, 2/6/2003] AP reporter Charles Hanley says that some of Powell’s claims that Iraq is hiding evidence are “ridiculous.” Powell says of a missile site, “This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” Hanley later says, “What he neglected to mention was that the inspectors were underneath, watching what was going on.” [PBS, 4/25/2007]
Communication Intercepts Demonstrate Iraqi Attempts to Conceal Information from Inspectors - Powell plays recordings of three conversations intercepted by US intelligence—one on November 26, another on January 30, and a third, a “few weeks” before. The conversations suggest that the Iraqis were attempting to hide evidence from inspectors. [New York Times, 2/5/2003; US Department of State, 2/5/2003; London Times, 2/6/2003; Sydney Morning Herald, 2/7/2003] Senior administration officials concede to the Washington Post that it was not known “what military items were discussed in the intercepts.” [Washington Post, 2/13/2003] Some critics argue that the intercepts were presented out of context and open to interpretation. [Sydney Morning Herald, 2/7/2003; Sydney Morning Herald, 2/9/2003] Others note that the conversations were translated from Arabic by US translators and were not analyzed or verified by an independent specialist. [Newsday, 2/6/2003]
Biological Weapons Factories - Colin Powell says that US intelligence has “firsthand descriptions” that Iraq has 18 mobile biological weapons factories mounted on trucks and railroad cars. Information about the mobile weapons labs are based on the testimonies of four sources—a defected Iraqi chemical engineer who claims to have supervised one of these facilities, an Iraqi civil engineer (see December 20, 2001), a source in “a position to know,” and a defected Iraqi major (see February 11, 2002). Powell says that the mobile units are capable of producing enough dry biological agent in a single month to kill several thousand people. He shows computer-generated diagrams and pictures based on the sources’ descriptions of the facilities. Powell says that according to the chemical engineer, during the late 1990s, Iraq’s biological weapons scientists would often begin the production of pathogens on Thursday nights and complete the process on Fridays in order to evade UNSCOM inspectors whom Iraq believed would not conduct inspections on the Muslim holy day. [New York Times, 2/5/2003; US Department of State, 2/5/2003; Washington Post, 2/6/2003; Reuters, 2/11/2003] Powell tells the delegates, “The source was an eyewitness, an Iraqi chemical engineer, who supervised one of these facilities. He actually was present during biological agent production runs. He was also at the site when an accident occurred in 1998. Twelve technicians died from exposure to biological agents.” He displays models of the mobile trucks drawn from the source’s statements. [CBS News, 11/4/2007] Responding to the allegation, Iraqi officials will concede that they do in fact have mobile labs, but insist that they are not used for the development of weapons. According to the Iraqis, the mobile labs are used for food analysis for disease outbreaks, mobile field hospitals, a military field bakery, food and medicine refrigeration trucks, a mobile military morgue and mobile ice making trucks. [Guardian, 2/5/2003; ABC News, 5/21/2003] Iraq’s explanation is consistent with earlier assessments of the UN weapons inspectors. Before Powell’s presentation, Hans Blix had dismissed suggestions that the Iraqis were using mobile biological weapons labs, reporting that inspections of two alleged mobile labs had turned up nothing. “Two food-testing trucks have been inspected and nothing has been found,” Blix said. And Ewen Buchanan, spokesman for the UN Monitoring, Verification and Inspection Commission, said, “The outline and characteristics of these trucks that we inspected were all consistent with the declared purposes.” [Guardian, 2/5/2003; ABC News, 5/21/2003]
'Curveball' Primary Source of Claims - Powell’s case is further damaged when it is later learned that one of the sources Powell cited, the Iraqi major, had been earlier judged unreliable by intelligence agents at the Defense Intelligence Agency (see February 11, 2002). In May 2002, the analysts had issued a “fabricator notice” on the informant, noting that he had been “coached by [the] Iraqi National Congress” (INC) (see May 2002). But the main source for the claim had been an Iraqi defector known as “Curveball,” who was initially believed to be the brother of a top aide to Ahmed Chalabi. The source claimed to be a chemical engineer who had helped design and build the mobile labs. His information was passed to Washington through Germany’s intelligence service, the Bundesnachrichtendienst (BND), which had been introduced to the source by the INC. In passing along the information, the BND noted that there were “various problems with the source.” And only one member of the US intelligence community had actually met with the person—an unnamed Pentagon analyst who determined the man was an alcoholic and of dubious reliability. Yet both the DIA and the CIA validated the information. [Veteran Intelligence Professionals for Sanity, 8/22/2003; Los Angeles Times, 3/28/2004; Knight Ridder, 4/4/2004; Newsweek, 4/19/2004; Newsweek, 7/19/2004] Powell says that the US has three other intelligence sources besides Curveball for the mobile bioweapons labs. Powell will be infuriated to learn that none of those three sources ever corroborated Curveball’s story, and sometimes their information contradicted each other. One of the three had failed a polygraph test and was determined to have lied to his debriefers. Another had already been declared a fabricator by US intelligence community, and had been proven to have mined his information off the Internet. [Buzzflash (.com), 11/27/2007] In November 2007, Curveball is identified as Rafid Ahmed Alwan. Serious questions about Curveball’s veracity had already been raised by the time of Powell’s UN presentation. He will later be completely discredited (see November 4, 2007).
Further Problems with Mobile Lab Claims - In addition to the inspectors’ assessments and the dubious nature of the sources Powell cited, there are numerous other problems with the mobile factories claim. Raymond Zilinskas, a microbiologist and former UN weapons inspector, argues that significant amounts of pathogens such as anthrax, could not be produced in the short span of time suggested in Powell’s speech. “You normally would require 36 to 48 hours just to do the fermentation…. The short processing time seems suspicious to me.” He also says: “The only reason you would have mobile labs is to avoid inspectors, because everything about them is difficult. We know it is possible to build them—the United States developed mobile production plants, including one designed for an airplane—but it’s a big hassle. That’s why this strikes me as a bit far-fetched.” [Washington Post, 2/6/2003] After Powell’s speech, Blix will say in his March 7 report to the UN that his inspectors found no evidence of mobile weapons labs (see March 7, 2003). [CNN, 3/7/2003; Agence France-Presse, 3/7/2003; CNN, 3/7/2003] Reporter Bob Drogin, author of Curveball: Spies, Lies and the Con Man Who Caused a War, says in 2007, “[B]y the time Colin Powell goes to the UN to make the case for war, he shows the world artists’ conjectures based on analysts’ interpretations and extrapolations of Arabic-to-German-to-English translations of summary debriefing reports of interviews with a manic-depressive defector whom the Americans had never met. [CIA director George] Tenet told Powell that Curveball’s information was ironclad and unassailable. It was a travesty.” [Alternet, 10/22/2007]
'Four Tons' of VX Toxin - Powell also claims that Iraq has “four tons” of VX nerve toxin. “A single drop of VX on the skin will kill in minutes,” he says. “Four tons.” Hanley later notes, “He didn’t point out that most of that had already been destroyed. And, on point after point he failed to point out that these facilities about which he was raising such alarm were under repeated inspections good, expert people with very good equipment, and who were leaving behind cameras and other monitoring equipment to keep us a continuing eye on it.” [PBS, 4/25/2007]
Iraq is Developing Unmanned Drones Capable of Delivering Weapons of Mass Destruction - Powell asserts that Iraq has flight-tested an unmanned drone capable of flying up to 310 miles and is working on a liquid-fueled ballistic missile with a range of 745 miles. He plays a video of an Iraqi F-1 Mirage jet dispersing “simulated anthrax.” [US Department of State, 2/5/2003; New York Times, 2/5/2003; Washington Post, 2/6/2003] But the Associated Press will later report that the video was made prior to the 1991 Gulf War. Apparently, three of the four spray tanks shown in the film had been destroyed during the 1991 military intervention. [Associated Press, 8/9/2003]
Imported Aluminum Tubes were Meant for Centrifuge - Powell argues that the aluminum tubes which Iraq had attempted to import in July 2001 (see July 2001) were meant to be used in a nuclear weapons program and not for artillery rockets as experts from the US Energy Department, the INR, and the IAEA have been arguing (see February 3, 2003) (see January 11, 2003) (see August 17, 2001) (see January 27, 2003). To support the administration’s case, he cites unusually precise specifications and high tolerances for heat and stress. “It strikes me as quite odd that these tubes are manufactured to a tolerance that far exceeds US requirements for comparable rockets,” he says. “Maybe Iraqis just manufacture their conventional weapons to a higher standard than we do, but I don’t think so.” Powell also suggests that because the tubes were “anodized,” it was unlikely that they had been designed for conventional use. [US Department of State, 2/5/2003; Washington Post, 2/5/2003; Washington Post, 3/8/2003] Powell does not mention that numerous US nuclear scientists have dismissed this claim (see August 17, 2001) (see September 23, 2002) (see December 2002). [Albright, 10/9/2003] Powell also fails to say that Iraq has rockets identical to the Italian Medusa 81 mm rockets, which are of the same dimensions and made of the same alloy as the 3,000 tubes that were intercepted in July 2001 (see After January 22, 2003). [Washington Post, 8/10/2003] This had been reported just two weeks earlier by the Washington Post. [Washington Post, 1/24/2003] Moreover, just two days before, Powell was explicitly warned by the US State Department’s Bureau of Intelligence and Research not to cite the aluminum tubes as evidence that Iraq is pursuing nuclear weapons (see February 3, 2003). [Financial Times, 7/29/2003]
Iraq Attempted to Acquire Magnets for Use in a Gas Centrifuge Program - Powell says: “We… have intelligence from multiple sources that Iraq is attempting to acquire magnets and high-speed balancing machines. Both items can be used in a gas centrifuge program to enrich uranium. In 1999 and 2000, Iraqi officials negotiated with firms in Romania, India, Russia and Slovenia for the purchase of a magnet production plant. Iraq wanted the plant to produce magnets weighing 20 to 30 grams. That’s the same weight as the magnets used in Iraq’s gas centrifuge program before the Gulf War.” [US Department of State, 2/5/2003; New York Times, 2/6/2003] Investigation by the UN’s International Atomic Energy Agency [IAEA] will demonstrate that the magnets have a dual use. IAEA Director Mohamed ElBaradei said a little more than a week before, on January 27, in his report to the Security Council: “Iraq presented detailed information on a project to construct a facility to produce magnets for the Iraqi missile program, as well as for industrial applications, and that Iraq had prepared a solicitation of offers, but that the project had been delayed due to ‘financial credit arrangements.’ Preliminary investigations indicate that the specifications contained in the offer solicitation are consistent with those required for the declared intended uses. However, the IAEA will continue to investigate the matter….” (see January 27, 2003) [Annan, 1/27/2003 pdf file] On March 7, ElBaradei will provide an additional update: “The IAEA has verified that previously acquired magnets have been used for missile guidance systems, industrial machinery, electricity meters and field telephones. Through visits to research and production sites, reviews of engineering drawings and analyses of sample magnets, IAEA experts familiar with the use of such magnets in centrifuge enrichment have verified that none of the magnets that Iraq has declared could be used directly for a centrifuge magnetic bearing.” (see March 7, 2003) [CNN, 3/7/2003]
Iraq Attempted to Purchase Machines to Balance Centrifuge Rotors - Powell states: “Intercepted communications from mid-2000 through last summer show that Iraq front companies sought to buy machines that can be used to balance gas centrifuge rotors. One of these companies also had been involved in a failed effort in 2001 to smuggle aluminum tubes into Iraq.” [US Department of State, 2/5/2003; New York Times, 2/6/2003]
Powell Cites Documents Removed from Home of Iraqi Scientist Faleh Hassan - Powell cites the documents that had been found on January 16, 2003 by inspectors with the help of US intelligence at the Baghdad home of Faleh Hassan, a nuclear scientist. Powell asserts that the papers are a “dramatic confirmation” that Saddam Hussein is concealing evidence and not cooperating with the inspections. The 3,000 documents contained information relating to the laser enrichment of uranium (see January 16, 2003). [Daily Telegraph, 1/18/2003; Associated Press, 1/18/2003; BBC, 1/19/2003; US Department of State, 2/5/2003] A little more than a week later, in the inspectors’ February 14 update to the UN Security Council (see February 14, 2003), ElBaradei will say, “While the documents have provided some additional details about Iraq’s laser enrichment development efforts, they refer to activities or sites already known to the IAEA and appear to be the personal files of the scientist in whose home they were found. Nothing contained in the documents alters the conclusions previously drawn by the IAEA concerning the extent of Iraq’s laser enrichment program.” [Guardian, 2/15/2003; BBC, 2/17/2003; Associated Press, 8/9/2003]
Iraq is Hiding Missiles in the Desert - Powell says that according to unidentified sources, the Iraqis have hidden rocket launchers and warheads containing biological weapons in the western desert. He further contends that these caches of weapons are hidden in palm groves and moved to different locations on a weekly basis. [US Department of State, 2/5/2003] It will later be suggested that this claim was “lifted whole from an Iraqi general’s written account of hiding missiles in the 1991 war.” [Associated Press, 8/9/2003]
Iraq Has Scud Missiles - Powell also says that according to unnamed “intelligence sources,” Iraq has a few dozen Scud-type missiles. [Associated Press, 8/9/2003]
Iraq Has Weapons of Mass Destruction - Secretary of State Colin Powell states unequivocally: “We… have satellite photos that indicate that banned materials have recently been moved from a number of Iraqi weapons of mass destruction facilities. There can be no doubt that Saddam Hussein has biological weapons and the capability to rapidly produce more, many more.” Elsewhere in his speech he says: “We know that Saddam Hussein is determined to keep his weapons of mass destruction, is determined to make more.” [US Department of State, 2/5/2003; CNN, 2/5/2003]
Governments, Media Reaction Mixed - Powell’s speech will fail to convince many skeptical governments, nor will it impress many in the European media. But it will have a tremendous impact in the US media (see February 5, 2003 and After).

'Vast Arsenal' of WMDs - “The regime has never accounted for a vast arsenal of deadly biological and chemical weapons. …. The Iraqi regime has actively and secretly attempted to obtain equipment needed to produce chemical, biological, and nuclear weapons. Firsthand witnesses have informed us that Iraq has at least seven mobile factories for the production of biological agents, equipment mounted on trucks and rails to evade discovery. Using these factories, Iraq could produce within just months hundreds of pounds of biological poisons.… Iraq has never accounted for thousands of bombs and shells capable of delivering chemical weapons. The regime is actively pursuing components for prohibited ballistic missiles. And we have sources that tell us that Saddam Hussein recently authorized Iraqi field commanders to use chemical weapons—the very weapons the dictator tells the world he does not have.” [US President, 2/10/2003]
WMD Delivery Systems - “The Iraqi regime has acquired and tested the means to deliver weapons of mass destruction. All the world has now seen the footage of an Iraqi Mirage aircraft with a fuel tank modified to spray biological agents over wide areas. Iraq has developed spray devices that could be used on unmanned aerial vehicles with ranges far beyond what is permitted by the Security Council. A UAV launched from a vessel off the American coast could reach hundreds of miles inland.” [US President, 2/10/2003]
Iraq and al-Qaeda - “One of the greatest dangers we face is that weapons of mass destruction might be passed to terrorists, who would not hesitate to use those weapons. Saddam Hussein has longstanding, direct and continuing ties to terrorist networks. Senior members of Iraqi intelligence and al-Qaeda have met at least eight times since the early 1990s. Iraq has sent bomb-making and document forgery experts to work with al-Qaeda. Iraq has also provided al-Qaeda with chemical and biological weapons training.” [US President, 2/10/2003; Newsweek, 11/10/2005]
Harboring Terrorists - “We also know that Iraq is harboring a terrorist network, headed by a senior al-Qaeda terrorist planner. The network runs a poison and explosive training center in northeast Iraq, and many of its leaders are known to be in Baghdad. The head of this network traveled to Baghdad for medical treatment and stayed for months. Nearly two dozen associates joined him there and have been operating in Baghdad for more than eight months.” [US President, 2/10/2003]
Choice of Freedom - “[W]e can give the Iraqi people their chance to live in freedom and choose their own government.… Saddam Hussein has made Iraq into a prison, a poison factory, and a torture chamber for patriots and dissidents.” [US President, 2/10/2003]
