The organization, according to the founders, exists “to combat radicalism, preserve property rights, uphold and preserve the Constitution.” ALL spokesman Jouett Shouse says ALL will fight to preserve “traditional American political values.” According to the Encyclopedia of the Great Depression, ALL was organized by “disgruntled business conservatives, Wall Street financiers, right-wing opponents of Franklin D. Roosevelt’s New Deal, and defeated rivals within Roosevelt’s Democratic Party.” ALL is financed by, among others, industrialists Pierre, Irenee, and Lammot du Pont; former Democratic Party chairman John J. Raskob; financier E.F. Hutton; and executive Sewell Avery of the department store chain Montgomery Ward. Most of the politicians in the organization are Republicans, but these are joined by anti-Roosevelt Democrats such as Alfred E. Smith, who ran for president in 1928. Many ALL members were once part of the Association against the Prohibition Amendment, which fought to re-legalize the US liquor industry. ALL unsuccessfully fights to block federal regulations and additional taxes on business, the creation of public power utilities, pro-labor barganing rights, agricultural production controls and subsidies, New Deal relief and public jobs programs, the Works Progress Administration (WPA), Social Security, and other Roosevelt-era programs and initiatives. According to the Encyclopedia, “critics effectively lampooned league members as champions of privilege, ungrateful critics of an administration that had saved capitalism, and vindictive and selfish individuals seeking revenge on a president for betraying his social class.” ALL works diligently, but unsuccessfully, to unseat Roosevelt in 1936, backing Republican contender Alfred M. Landon. After Landon loses in a landslide to Roosevelt, the organization fades in prominence. The Encyclopedia concludes that ALL’s “legacy of fund-raising tactics, ideology-driven issues research and public education, and coordination with partisan legislative and electoral campaigns foreshadowed today’s political action committees and independent-expenditure organizations.” [New York Times, 8/23/1934; Encyclopedia of the Great Depression, 1/1/2004] In 2003, columnist Ralph De Toledano will write, “The Liberty League was laughed out of existence by New Yorker cartoonists, who depicted its members looking out over Fifth Avenue and snorting that doomsday was here and Josef Stalin lurked in the bushes.” [Insight, 9/2/2003] In 2010, writer Kevin Drum will compare the American Liberty League to the tea party movement (see September 2010). Koch Industries logo.Koch Industries logo. [Source: Koch Industries / Wikipedia]Oil magnate Fred Koch co-founds Wood River Oil and Refining Company, later renamed Koch Industries. The firm will grow to become one of the largest energy conglomerates in the US, and Koch will become an influential backer of right-wing politics. Koch is a virulent anti-Communist who will be one of the first members of the John Birch Society (JBS—see March 10, 1961 and December 2011), a far-right organization that reflects his hatred of Communism (he believes both the Republican and Democratic parties are irretrievably infilitrated by Communists) and opposes almost every aspect of governance in general. Koch will write glowingly of Italian dictator Benito Mussolini’s murderous suppression of Communists during World War II. Both Koch and the JBS have little use for minorities; of African-Americans, Koch will write, “The colored man looms large in the Communist plan to take over America,” and he will say that government welfare programs were designed to attract large numbers of blacks to the cities, where they would foment “a vicious race war.” In 1963, using language that reporter Jane Mayer will later say “prefigures the Tea Party’s talk of a secret socialist plot,” Koch will warn that Communists would “infiltrate the highest offices of government in the US until the president is a Communist, unknown to the rest of us.” Koch’s two sons, David and Charles, will have their father’s political views deeply ingrained into them (see August 30, 2010). In 2007, David Koch will tell a reporter: “He was constantly speaking to us children about what was wrong with government.… It’s something I grew up with—a fundamental point of view that big government was bad, and imposition of government controls on our lives and economic fortunes was not good.” Gus diZerega, once a close friend of Charles’s, will later say that the brothers transfer their father’s hatred of Communism to the US government, which they will come to view as a tyranny. DiZerega will write that the Kochs, like many other hard-right conservatives, redefine “socialism” as almost any form of government which taxes citizens and regulates businesses. The Smith-Connally Act restricts contributions to federal candidates from labor unions as well as from corporate and interstate banks (see 1925). The law is passed in response to the powerful influence of labor unions in elections beginning in 1936, where some unions used labor dues to support federal candidates [Center for Responsive Politics, 2002 pdf file] , and by public outrage at a steelworkers’ union going on strike for higher wages during the war, an action characterized by many as unpatriotic. The law was written both to punish labor unions and to make lawmakers less dependent on them and their contributions. [Campaign Finance Timeline, 1999] One example held up to scrutiny is the 1936 donation of $500,000 in union funds to the Democratic Party by John L. Lewis of the Congress of Industrial Organizations (CIO). [Connecticut Network, 2006 pdf file] Motivated by anti-union and anti-liberal sentiment after the war’s end, the Taft-Hartley Act (see June 23, 1947) will make the ban permanent. [Source: Spectator]As World War II is coming to a close, the US Public Health Service (USPHS) begins a pilot program in Michigan to add fluoride to selected cities’ water supply, as a tooth-decay preventative. By 1950, 87 American towns and cities volunteer to have the agency fluoridate their water supply. By the early 1950s, water fluoridation is compulsory. Studies show that children between the ages of 5 and 9 show significantly smaller rates of cavities and tooth decay when they regularly drink fluoridated water, though studies of older children and adults are less clear. As the federal government begins rolling out its mandatory fluoridation program, far-right organizations such as the John Birch Society (JBS—see March 10, 1961 and December 2011) and the Ku Klux Klan (KKK) begin taking rigid stances against it. The JBS, a staunchly anti-Communist organization, accuses the federal government of imposing “creeping socialism” and “Soviet Communism” on the nation by making fluoridated water mandatory, and warns Americans against the government “polluting our precious bodily fluids.” (In 1993, JBS member Murray N. Rothbard differentiates between the brands of communism at work, saying, “[N]o, not Bolsheviks, guys: but a Menshevik-State Capitalist alliance.”) The JBS, in accusations later echoed by Rothbard, accuses the government of working with aluminum manufacturer Alcoa to dump sodium fluoride, a byproduct of aluminum manufacturing, into the nation’s water supply and rid Alcoa of the cost of disposing of the substance. The 1964 satirical film Dr. Strangelove features a character, General Jack D. Ripper, shouting, “Do you realize that fluoridation is the most monstrously conceived and dangerous Communist plot we have ever had to face?” [New American, 1/1993; Reason, 12/5/2001; Hileman, 5/2008] In 1988, the Fluoride Action Network notes that the two opposing camps—fluoridation is beneficial and has no side effects vs. fluoridation is useless and harmful—have fought to an argumentative standstill, with no middle ground between the two. Jacqueline Warren, an attorney with the National Resources Defense Council, says, “Neither side has given the other one rational moment.” [Hileman, 5/2008] In the early 1990s, environmentalist and public health safety groups begin calling for new examinations of the impact of fluoride on the human body, pointing to “valid concerns” about fluoride having a toxic impact on the human body and on the environment. In 2008, one JBS member warns, perhaps sardonically, “Don’t be surprised if we learn soon that the fluoride in Chinese toothpaste is nuclear waste from North Korea.” [Reason, 12/5/2001; Mother Jones, 5/2008]

The Taft-Hartley Act makes permanent the ban on contributions to federal candidates from unions (see June 25, 1943), corporations, and interstate banks (see 1925), and extends the regulations to cover primaries as well as general elections. It also requires union leaders to affirm that they are not supporters of the Communist Party. President Harry S. Truman unsuccessfully vetoed the bill when it was sent to his desk, and when Congress passes it over his veto, he echoes AFL-CIO leader John L. Lewis by denouncing the law as a “slave-labor bill.” Taft-Hartley declares the unions’ practice of “closed shops” illegal (employers agreeing with unions to hire only union members, and require employees to join the union), and permits unions to have chapters at a business only if approved by a majority of employees. The law also permits employers to refuse to bargain with unions if they choose. A Time magazine profile lambasts the racist, anti-Communist John Birch Society (JBS—see December 2011), in what is many Americans’ first exposure to the group. It delineates the organization’s penchant for secrecy, its domination by its “dictatorial” leader, Robert Welch, and its hardline battle against almost every element of the federal government as “agents of Communism.” Forty to 60 percent of the federal government is controlled by Communism, the JBS believes. Time calls the organization “a tiresome, comic-opera joke” that nonetheless has cells in 35 states and an ever-widening influence. In Wichita, Kansas, JBS student members are trained to inform their cell leaders of “Communist” influences they may detect in their classroom lectures, and the offending teacher is berated by parents. A Wichita businessman who wanted to give a donation to the University of Wichita decided not to donate after being hounded by local JBS members, who wanted the university to fire professors and remove selected books from its library. “My business would be wrecked,” the businessman explains, “if those people got on the phone and kept on yelling that I am a Communist because I give money to the school.” Nashville, Tennessee, JBS members organize community members to verbally attack neighbors whom they suspect of Communist affiliations. JBS’s current priority, Time writes, is to bring about the impeachment of Chief Justice Earl Warren. Welch, who obtained his wealth from his brother’s candymaking business, believes that Social Security and the federal income tax are all part of the “creeping socialism” that is taking over the federal government. He retired from the business in 1957 and founded the JBS shortly thereafter, naming it for a US Navy captain killed by Chinese Communist guerrillas after the end of World War II. Welch’s seminal tract, “The Politician,” accuses President Eisenhower and his brother Milton Eisenhower of being Communist plants, and accuses both men of treason against the nation. [Source: Larry DeWitt]The American Medical Association (AMA) releases an 11-minute spoken-word album (LP) featuring actor and promising conservative politician Ronald Reagan. Reagan speaks against what he and the AMA call the “socialized medicine” of Medicare, currently being considered in Congress as part of legislation proposed by Democrats Cecil King and Clinton Anderson; many refer to the legislation as the King-Anderson bill. The AMA, along with most Congressional Republicans and a good number of Democrats, has been fighting the idea of government-provided health care since 1945 (see 1962).
Socialism Advancing under Cover of Liberal Policies - Reagan begins by warning that as far back as 1927, American socialists determined to advance their cause “under the name of liberalism.” King-Anderson is a major component of the secret socialist agenda, Reagan says. “One of the traditional methods of imposing statism or socialism on a people has been by way of medicine,” he says. “It’s very easy to disguise a medical program as a humanitarian project.” No real American wants socialized medicine, Reagan says, but Congress is attempting to fool the nation into adopting just such a program. It has already succeeded in imposing a socialist program on the country by creating and implementing Social Security, which was originally envisioned to bring “all people of Social Security age… under a program of compulsory health insurance.” Reagan, following the AMA’s position, says that the current “Eldercare” program, often called “Kerr-Mills” for its Congressional sponsors, is more than enough to cover elderly Americans’ medical needs. (Author Larry DeWitt notes that in 1965, Kerr-Mills will be superseded by Medicaid, the medical program for the poor. He will write, “So Reagan—on behalf of the AMA—was suggesting that the nation should be content with welfare benefits under a Medicaid-type program as the only form of government-provided health care coverage.”) King-Anderson is nothing more than “simply an excuse to bring about what [Democrats and liberals] wanted all the time: socialized medicine,” Reagan says. And once the Medicare proposal of King-Anderson is in place, he argues, the government will begin constructing an entire raft of socialist programs, and that, he says, will lead to the destruction of American democracy. “The doctor begins to lose freedom,” he warns. “First you decide that the doctor can have so many patients. They are equally divided among the various doctors by the government. But then doctors aren’t equally divided geographically. So a doctor decides he wants to practice in one town and the government has to say to him, you can’t live in that town. They already have enough doctors. You have to go someplace else. And from here it’s only a short step to dictating where he will go.… All of us can see what happens once you establish the precedent that the government can determine a man’s working place and his working methods, determine his employment. From here it’s a short step to all the rest of socialism, to determining his pay. And pretty soon your son won’t decide, when he’s in school, where he will go or what he will do for a living. He will wait for the government to tell him where he will go to work and what he will do.” DeWitt will note that this is far more extravagant than any of the Medicare proposals ever advanced by any lawmaker: “It was this more apocalyptic version of Medicare’s potential effects on the practice of medicine that Reagan used to scare his listeners.”
Advocating Letter-Writing Campaign - Reagan tells his listeners that they can head off the incipient socialization of America by engaging in a nationwide letter-writing campaign to flood Congress with their letters opposing King-Anderson. “You and I can do this,” he says. “The only way we can do it is by writing to our congressman even if we believe he’s on our side to begin with. Write to strengthen his hand. Give him the ability to stand before his colleagues in Congress and say, ‘I heard from my constituents and this is what they want.’”
Apocalypse - If the effort fails, if Medicare passes into law, the consequences will be dire beyond imagining, Reagan tells his audience: “And if you don’t do this and if I don’t do it, one of these days you and I are going to spend our sunset years telling our children, and our children’s children, what it once was like in America when men were free.” Reagan is followed up by an unidentified male announcer who reiterates Reagan’s points and gives “a little background on the subject of socialized medicine… that now threatens the free practice of medicine.” Reagan then makes a brief closing statement, promising that if his listeners do not write those letters, “this program I promise you will pass just as surely as the sun will come up tomorrow. And behind it will come other federal programs that will invade every area of freedom as we have known it in this country, until, one day… we will awake to find that we have socialism. And if you don’t do this, and if I don’t do it, one of these days, you and I are going to spend our sunset years telling our children, and our children’s children, what it once was like in America when men were free.” [Larry DeWitt, 9/2004; TPMDC, 8/25/2009]

Cleon Skousen, a supporter of the John Birch Society (JBS—see December 2011), writes an article attacking the Time profile of the JBS (see March 10, 1961) as being part of an orchestrated Communist attack on the organization. The article came about after the international Communist Party “ordered” the “annihilation” of the JBS, Skousen says. Skousen denies the group’s penchant for secrecy, saying that it was openly set up in 1958 as a network of “study groups” examining the threat of Communism to American society. The organization, he writes, is nothing more than “a study group program with a strong bias in favor of traditional American constitutionalism.” By 1960, the JBS earned the enmity of competing conservative groups, Skousen says, because the organization “had rallied together most of the best informed and hardest working patriots in many cities.” However, he writes, JBS members tend to be part of other conservative movements as well. The JBS worked to defeat a bill, slated to be introduced in January 1961, that would largely defund the House Committee on Un-American Activities “so it could not investigate the Communist Party.” Skousen says that JBS efforts derailed the bill, handing the American Communist Party “an overwhelming defeat.” After the bill was defeated, Skousen says, “a manifesto… from Moscow” ordered the destruction of the JBS, as it posed the primary danger to “Communist progress” in the US. The Time magazine profile of the JBS was part of that effort, Skousen says, after the organization was attacked in the pages of the Daily People’s World, a West Coast publication that Skousen says was “the official Communist newspaper” of that area. Within days, the information in the article was reprinted in Time’s own article, which reached far more people than the People’s World. “[T]he thing which astonished me,” Skousen writes, “was the rapidity with which the transmission belt began to function so that this story was planted in one major news medium after another until finally even some of the more conservative papers had taken up the hue and cry.” Skousen calls the article a Communist plant filled with fabrications and lies. He says that JBS leader Robert Welch’s accusations that President Eisenhower and other pro-American world leaders are Communists were made in “private communication[s] to his friends” and were never part of official JBS principles, and took place well before Welch founded the JBS in 1957; therefore, Skousen writes, to report Welch’s characterizations is to smear the JBS. Skousen also denies any racism or anti-Semitism on the JBS’s part, and uses a sympathetic 1963 report by the California Senate Factfinding Committee to “prove” his claims. The report concluded that Welch and the JBS have “stirred the slumbering spirit of patriotism in thousands of Americans, roused them from lethargy, and changed their apathy into a deep desire to first learn the facts about communism and then implement that knowledge with effective and responsible action.” Skousen concludes that while Americans are free to disagree with JBS principles and actions, any criticism of the organization should be considered potential Communist propaganda designed to smear the organization and reduce its effectiveness. If the criticism does not come from Communists themselves, it plays into Communist hands. As he claims to have been told by “[a] former member of the Communist Party National Committee,” “The Communist leaders look upon the stamping out of the John Birch Society as a matter of life and death for the Party.” [Our Republic, 1963]

[Source: Spartacus Schoolnet (.com)]The John Birch Society (JBS—see March 10, 1961 and December 2011), an anti-Communist organization that embraces racist and white supremacist ideologies, distrubutes posters throughout Dallas accusing President Kennedy of committing treason against the United States. The poster distribution is timed to coincide with Kennedy’s visit to Dallas, where he is scheduled to drive through the city in a motorcade on November 22. Kennedy will be assassinated during that motorcade. The poster, designed to appear as a “Wanted” notice, enumerates the following “charges” against Kennedy:
bullet “Betraying the Constitution (which he swore to uphold). He is turning the sovereignty of the US over to the Communist controlled United Nations. He is betraying our friends (Cuba, Katanga, Portugal) and befriending our enemies (Russia, Yugoslavia, Poland).”
bullet “He has been WRONG on innumerable issues affecting the security of the US (United Nations, Berlin Wall, Missile Removal, Cuba, Wheat deals, Test Ban Treaty, etc.).”
bullet “He has been lax in enforcing the Communist Registration laws.”
bullet “He has given support and encouragement to the Communist-inspired racial riots.”
bullet “He has illegally invaded a sovereign State with federal troops.”
bullet “He has consistently appointed Anti-Christians to Federal office. Upholds the Supreme Court in Anti-Christian rulings. Aliens and known Communists abound in Federal offices.”

[Source: White House Photo Office / Rolling Stone]Roger Ailes, the media consultant for the Richard Nixon presidential campaign, decides that Nixon should, during a televised town hall, take a staged question from a “good, mean, Wallaceite cab driver.” Ailes is referring to the overtly racist third-party candidacy of Governor George Wallace (D-AL). Ailes suggests “[s]ome guy to sit there and say, ‘Awright, Mac, what about these n_ggers?’” According to Nixonland author Rick Pearlstein, the idea is to have Nixon “abhor the uncivility of the words, while endorsing a ‘moderate’ version of the opinion.” [Pearlstein, 5/2008, pp. 331; Media Matters, 7/22/2011] The suggestion is not used. Ailes will go on to found Fox News (see October 7, 1996).

Early 1970s: Idaho Racist Founds Aryan Nations

[Source: Southern Poverty Law Center]Aerospace engineer and white racist Richard Butler, who departed California in the early 1970s and moved into a rural farmhouse in Hayden Lake, Idaho, founds and develops one of the nation’s most notorious and violent white separatist groups, the Aryan Nations. Butler’s 20-acre farmhouse becomes the compound for the group and its affiliated church, the Church of Jesus Christ Christian; Butler and his nascent organization envision a “whites-only” “homeland” in the Pacific Northwest. At age 11, Butler read a serialized novel in Liberty Magazine, depicting the takeover of the US by “race-mixing Bolsheviks” that deeply impressed him. As a young man, he worked as an aeronautical engineer in India, where he was fascinated by the Indian caste structure and the concept of racial purity. In 1941 he left a Los Angeles church after concluding that the preacher was spreading Communist doctrine. During World War II, as an Army engineer, he became fascinated by the German military, and later recalls that he “was thrilled to see the movies of the marching Germans.… In those days, all we knew was that Hitler hated communists, and so did my folks—as we did as teenagers.” In the 1950s, Butler was enthralled by radio broadcasts of then-Senator Joseph McCarthy (R-WI) and his “Red scare” accusations, and sent money to support McCarthy’s political campaigns. During that time, Butler met William Potter Gale, another white supremacist who went on to found the Posse Comitatus (see 1969). Butler held a high position in the Christian Defense League, an organization founded by the Reverend Wesley Swift and described by the Southern Poverty Law Center (SPLC) as “virulently anti-Semitic,” until 1965, and shortly thereafter became a mail-order “ordained minister” of Christian Identity, a white supremacist offshoot of the Christian church (see 1960s and After). Butler buys the farmhouse in Hayden Lake and founds his own “Christian Posse Comitatus,” and thereafter founds the Church of Jesus Christ Christian. Roger Ailes, the senior media consultant for the Nixon administration (see 1968), writes, or helps write, a secret memo for President Nixon and fellow Republicans outlining a plan for conservatives to “infiltrate and neutralize” the mainstream American media. The document will not be released until 2011; experts will call it the “intellectual forerunner” to Fox News, which Ailes will launch as a “fair and balanced” news network in 1996 (see October 7, 1996). John Cook, the editor of the online news and commentary magazine Gawker, will call the document the outline of a “nakedly partisan… plot by Ailes and other Nixon aides to circumvent the ‘prejudices of network news’ and deliver ‘pro-administration’ stories to heartland television viewers.” The document is entitled “A Plan for Putting the GOP on TV News.” Ailes, currently the owner of REA Productions and Ailes Communications Inc., works for the Nixon White House as a media consultant; he will serve the same function for President George H.W. Bush during his term. Ailes is a forceful advocate for using television to shape the message of the Nixon administration and of Republican policies in general. He frequently suggests launching elaborately staged events to entice favorable coverage from television reporters, and uses his contacts at the news networks to head off negative publicity. Ailes writes that the Nixon White House should run a partisan, pro-Republican media operation—essentially a self-contained news production organization—out of the White House itself. He complains that the “liberal media” “censors” the news to portray Nixon and his administration in a negative light. Cook will say the plan “reads today like a detailed precis for a Fox News prototype.” The initial idea may have originated with Nixon chief of staff H.R. Haldeman, but if so, Ailes expands and details the plan far beyond Haldeman’s initial seed of an idea. [Roger Ailes, 1970; Gawker, 6/30/2011] In 2011, Rolling Stone journalist Tim Dickinson will write: “This is an astounding find. It underscores Ailes’s early preoccupation with providing the GOP with a way to do an end run around skeptical journalists.” [Rolling Stone, 7/1/2011]
Focus on Television - Ailes insists that any such media plan should focus on television and not print. Americans are “lazy,” he writes, and want their thinking done for them: “Today television news is watched more often than people read newspapers, than people listen to the radio, than people read or gather any other form of communication. The reason: People are lazy. With television you just sit—watch—listen. The thinking is done for you.” Ailes says the Nixon administration should create its own news network “to provide pro-administration, videotape, hard news actualities to the major cities of the United States.” Other television news outlets such as NBC News, ABC News, CBS News, and PBS News, are “the enemy,” he writes, and suggests going around them by creating packaged, edited news stories and interviews directly to local television stations. (Years later, these kinds of “news reports” will be called “video news releases,” or VNRs, and will routinely be used by the George W. Bush administration and others—see March 15, 2004, May 19, 2004, March 2005, and March 13, 2005. They will be outlawed in 2005—see May 2005.) “This is a plan that places news of importance to localities (senators and representatives are newsmakers of importance to their localities) on local television news programs while it is still news. It avoids the censorship, the priorities, and the prejudices of network news selectors and disseminators.” Ailes and his colleagues include detailed cost analyses and production plans for such news releases. In a side note on the document, Ailes writes: “Basically a very good idea. It should be expanded to include other members of the administration such as cabinet involved in activity with regional or local interest. Also could involve GOP governors when in DC. Who would purchase equipment and run operation—White House? RNC [Republican National Committee]? Congressional caucus? Will get some flap about news management.”
Dirty Tricks - Ailes suggests planting “volunteers” within the Wallace campaign, referring to segregationist George Wallace (D-AL), whose third-party candidacy in 1968 almost cost Nixon the presidency. Ailes knows Wallace is planning a 1972 run as well, and is apparently suggesting a “mole” to either gather intelligence, carry out sabotage, or both. (Wallace’s plans for another run will be cut short by an assassination attempt—see May 15, 1972.) Ailes also suggests having his firm film interviews with Democrats who support Nixon’s Vietnam policies, such as Senators John Stennis (D-MS) and John McClellan (D-AR). Though Stennis and McClellan would believe that the interviews were for actual news shows, they would actually be carried out by Ailes operatives and financed by a Nixon campaign front group, the “Tell it to Hanoi Committee.” In June 1970, someone in the Nixon administration scuttles the plan, writing: “[T]he fact that this presentation is White House directed, unbeknownst to the Democrats on the show, presents the possibility of a leak that could severely embarrass the White House and damage significantly its already precarious relationship with the Congress. Should two powerful factors like Stennis and McClellan discover they are dupes for the administration the scandal could damage the White House for a long time to come.”
Volunteers to Head Program - Ailes writes that he wants to head any such “news network,” telling Haldeman: “Bob—if you decide to go ahead we would as a production company like to bid on packaging the entire project. I know what has to be done and we could test the feasibility for 90 days without making a commitment beyond that point.” Haldeman will grant Ailes’s request in November 1970, and will give the project a name: “Capitol News Service.” Haldeman will write: “With regard to the news programming effort as proposed last summer, Ailes feels this is a good idea and that we should be going ahead with it. Haldeman suggested the name ‘Capitol News Service’ and Ailes will probably be doing more work in this area.” Documents fail to show whether the “Capitol News Service” is ever actually implemented. Television News Incorporated - Ailes will be fired from the Nixon administration in 1971; he will go on to start a similar private concern, “Television News Incorporated” (TVN—see 1971-1975), an ideological and practical predecessor to Fox News. Dickinson will write: “More important, [the document] links the plot to create what would become Television News Incorporated—the Ailes-helmed ‘fair and balanced’ mid-1970s precursor to Fox News—to the Nixon White House itself.” [Gawker, 6/30/2011; Rolling Stone, 7/1/2011] A former business colleague of Ailes’s will say in 2011: “Everything Roger wanted to do when he started out in politics, he’s now doing 24/7 with his network [Fox News]. Roger Ailes, a former media consultant to the Nixon administration (see Summer 1970) who proposed a White House-run “news network” that would promote Republican-generated propaganda over what he calls “liberal” news reporting (see Summer 1970), moves on to try the idea in the private venue. Ailes works with a project called Television News Incorporated (TVN), a propaganda venue funded by right-wing beer magnate Joseph Coors. Conservative activist and Coors confidant Paul Weyrich will later call Ailes “the godfather behind the scenes” of TVN. To cloak the “news” outlet’s far-right slant, Ailes coins the slogan “Fair and Balanced” for TVN. In 2011, Rolling Stone reporter Tim Dickinson will write: “TVN made no sense as a business. The… news service was designed to inject a far-right slant into local news broadcasts by providing news clips that stations could use without credit—and for a fraction of the true costs of production. Once the affiliates got hooked on the discounted clips, its president explained, TVN would ‘gradually, subtly, slowly’ inject ‘our philosophy in the news.’ The network was, in the words of a news director who quit in protest, a ‘propaganda machine.’” Within weeks of TVN’s inception, its staff of professional journalists eventually has enough of the overt propaganda of their employer and begin defying management orders; Coors and TVN’s top management fire 16 staffers and bring in Ailes to run the operation. The operation is never successful, but during his tenure at TVN, Ailes begins plotting the development of a right-wing news network very similar in concept to the as-yet-unborn Fox News. TVN plans to invest millions in satellite distribution that would allow it not only to distribute news clips to other broadcasters, but to provide a full newscast with its own anchors and crew (a model soon used by CNN). Dickinson will write, “For Ailes, it was a way to extend the kind of fake news that he was regularly using as a political strategist.” Ailes tells a Washington Post reporter in 1972: “I know certain techniques, such as a press release that looks like a newscast. So you use it because you want your man to win.” Ailes contracts with Ford administration officials to produce propaganda for the federal government, providing news clips and scripts to the US Information Agency. Ailes insists that the relationship is not a conflict of interest. Unfortunately for Ailes and Coors, TVN collapses in 1975. One of its biggest problems is the recalcitrance of its journalists, who continue to resist taking part in what they see as propaganda operations. Ailes biographer Kerwin Swint will later say, “They were losing money and they weren’t able to control their journalists.” In a 2011 article for the online news and commentary magazine Gawker, John Cook will write: “Though it died in 1975, TVN was obviously an early trial run for the powerhouse Fox News would become. The ideas were the same—to route Republican-friendly stories around the gatekeepers at the network news divisions.” Dickinson will write that one of the lessons Ailes learns from TVN, and will employ at Fox, is to hire journalists who put ideological committment ahead of journalistic ethics—journalists who will “toe the line.” [Rolling Stone, 5/25/2011; Gawker, 6/30/2011] Ailes will go on to found Fox News, using the “fair and balanced” slogan to great effect (see October 7, 1996 and 1995).

The Supreme Court case Buckley v. Valeo, filed by Senator James L. Buckley (R-NY) and former Senator Eugene McCarthy (D-WI) against the Secretary of the Senate, Francis R. Valeo, challenges the constitutionality of the Federal Election Campaign Act (FECA—see February 7, 1972 and 1974) on free-speech grounds. The suit also named the Federal Election Commission (FEC) as a defendant. A federal appeals court validated almost all of FECA, and the plaintiffs sent the case to the Supreme Court. The Court upholds the contribution limits set by FECA because those limits help to safeguard the integrity of elections. However, the court overrules the limits set on campaign expenditures, ruling: “It is clear that a primary effect of these expenditure limitations is to restrict the quantity of campaign speech by individuals, groups, and candidates. The restrictions… limit political expression at the core of our electoral process and of First Amendment freedoms.” One of the most important aspects of the Supreme Court’s ruling is that financial contributions to political campaigns can be considered expressions of free speech, thereby allowing individuals to essentially make unrestricted donations. The Court implies that expenditure limits on publicly funded candidates are allowable under the Constitution, because presidential candidates may disregard the limits by rejecting public financing (the Court will affirm this stance in a challenge brought by the Republican National Committee in 1980).
Provisions of 'Buckley' - The Court finds the following provisions constitutional:
bullet Limitations on contributions to candidates for federal office;
bullet Disclosure and record-keeping provisions; and
bullet The public financing of presidential elections.
However, the Court finds these provisions unconstitutional:
bullet Limitations on expenditures by candidates and their committees, except for presidential candidates who accept public funding;
bullet The $1,000 limitation on independent expenditures;
bullet The limitations on expenditures by candidates from their personal funds; and
bullet The method of appointing members of the FEC, holding that as the method stands, it violates the principle of separation of powers.
In May 1976, following the Court’s ruling, the FEC will reconstitute its board with six presidential appointees after Senate confirmation. No Clear Authors - The opinion is labeled per curiam, a term usually reserved for brief and minor Court decisions when authorship of an opinion is less relevant. It is unclear exactly which Justices write the opinion. Most Court observers believe Justice William Brennan writes the bulk of the opinion, but Brennan’s biographers will later note that sections of the opinion are authored by Chief Justice Warren Burger and Justices Potter Stewart, Lewis Powell, and William Rehnquist. The opinion is an amalgamation of multiple authors, reflecting the several compromises made in the resolution of the decision. [New Yorker, 5/21/2012]
Criticism of 'Buckley' - Critics claim that the ruling enshrines the principle of “money equals speech.” The ruling also says that television and radio advertisements that do not expressly attack an individual candidate can be paid for with “unregulated” funds. This leads organizations to begin airing “attack ads” that masquerade as “issue ads,” ostensibly promoting or opposing a particular social or political issue and avoiding such words as “elect” or “defeat.” [National Public Radio, 2012] In 1999, law professor Burt Neuborne will write: “Buckley is like a rotten tree. Give it a good, hard push and, like a rotten tree, Buckley will keel over. The only question is in which direction.” Neuborne will write that his preference goes towards reasonable federal regulations of spending and contributions, but “any change would be welcome” in lieu of this decision, and even a completely deregulated system would be preferable to Buckley’s legal and intellectual incoherence. [New York Times, 5/3/2010] In 2011, law professor Richard Hasen will note that while the Buckley decision codifies the idea that contributions are a form of free speech, it also sets strict limitations on those contributions. Calling the decision “Solomonic,” Hasen will write that the Court “split the baby, upholding the contribution limits but striking down the independent spending limit as a violation of the First Amendment protections of free speech and association.” Hasen will reflect: “Buckley set the main parameters for judging the constitutionality of campaign finance restrictions for a generation. Contribution limits imposed only a marginal restriction on speech, because the most important thing about a contribution is the symbolic act of contributing, not the amount. Further, contribution limits could advance the government’s interest in preventing corruption or the appearance of corruption. The Court upheld Congress’ new contribution limits. It was a different story with spending limits, which the Court said were a direct restriction on speech going to the core of the First Amendment. Finding no evidence in the record then that independent spending could corrupt candidates, the Court applied a tough ‘strict scrutiny’ standard of review and struck down the limits.” [Slate, 10/25/2011] In 2012, reporter and author Jeffrey Toobin will call it “one of the Supreme Court’s most complicated, contradictory, incomprehensible (and longest) opinions.” [New Yorker, 5/21/2012]

[Source: Cato Institute]The billionaire Koch brothers, Charles and David, launch the libertarian Cato Institute, one of the first of many think tanks and advocacy organizations they will fund (see August 30, 2010). While records of the Koch funding of the institute are not fully available, the Center for Public Integrity learns that between 1986 and 1993 the Koch family gives $11 million to the institute. By 2010, Cato has over 100 full-time employees, and often succeeds in getting its experts and policy papers quoted by mainstream media figures. While the institute describes itself as nonpartisan, and is at times critical of both Republicans and Democrats, it consistently advocates for corporate tax cuts, reductions in social services, and laissez-faire environmental policies. One of its most successful advocacy projects is to oppose government initiatives to curb global warming. When asked why Cato opposes such federal and state initiatives, founder and president Ed Crane explains that “global warming theories give the government more control of the economy.” [New Yorker, 8/30/2010]

Oil billionaire David Koch runs for vice president on the Libertarian Party ticket. David and his brother Charles are the primary backers of hard-right libertarian politics in the US (see August 30, 2010); Charles, the dominant brother, is determined to tear government “out at the root,” as he will later be characterized by libertarian Brian Doherty. The brothers have thrown their support behind Libertarian presidential candidate Ed Clark, who is running against Republican Ronald Reagan from the right of the political spectrum. The brothers are frustrated by the legal limits on campaign financing, and they persuade the party to place David on the ticket as vice president, thereby enabling him to spend as much of his personal fortune as he likes. The Libertarian’s presidential campaign slogan is, “The Libertarian Party has only one source of funds: You.” In reality, the Koch brothers’ expenditures of over $2 million is the campaign’s primary source of funding. Clark tells a reporter that the Libertarians are preparing to stage “a very big tea party” because people are “sick to death” of taxes. The Libertarian Party platform calls for the abolition of the FBI and the CIA, as well as of federal regulatory agencies, such as the Securities and Exchange Commission and the Department of Energy. The platform proposes the abolition of Social Security, minimum-wage laws, gun control, and all personal and corporate income taxes; in return, it proposes the legalization of prostitution, recreational drugs, and suicide. Government should be reduced to only one function, the party proclaims: the protection of individual rights. Conservative eminence William F. Buckley Jr. calls the movement “Anarcho-Totalitarianism.” The Clark-Koch ticket receives only one percent of the vote in the November 1980 elections, forcing the Koch brothers to realize that their brand of politics isn’t popular. In response, Charles Koch becomes openly scornful of conventional politics. “It tends to be a nasty, corrupting business,” he says. “I’m interested in advancing libertarian ideas.” Doherty will later write that both Kochs come to view elected politicians as merely “actors playing out a script.” Doherty will quote a longtime confidant of the Kochs as saying that after the 1980 elections, the brothers decide they will “supply the themes and words for the scripts.” In order to alter the direction of America, they had to “influence the areas where policy ideas percolate from: academia and think tanks.” [New Yorker, 8/30/2010]

Young anti-government organizer Robert Jay Mathews, currently living on a rural property in Metaline Falls, Washington, joins the National Alliance, a white-supremacist group founded by author and activist William Pierce (see 1970-1974). Mathews is profoundly affected by Pierce’s book The Turner Diaries (see 1978) and other books, including Oswald Spengler’s The Decline of the West, Louis Beam’s Essays of a Klansman, and William Simpson’s Which Way Western Man? which tells of a plot by Jews to destroy “the White Christian race.” In early 1982, Mathews joins the Church of Jesus Christ Christian, located in the Aryan Nations compound in Hayden Lake, Idaho, and also joins the Aryan Nations. Both the church and the organization advocate the necessity of creating a “white homeland” in northern Idaho. Mathews then founds the White American Bastion, a splinter group designed to bring Christian families to the Northwest. [Kushner, 2003, pp. 222; HistoryLink, 12/6/2006] Mathews will go on to found The Order, one of the most violent anti-government organizations in modern US history (see Late September 1983). He will die during a 1984 standoff with FBI agents (see December 8, 1984).

Lee Atwater.Lee Atwater. [Source: NNDB (.com)]Republican political strategist Lee Atwater, in a discussion with political science professor Alexander Lamis, discusses the Republican strategy of using racism to win elections. Lamis will later quote Atwater in his book Southern Politics in the 1990s. Atwater takes Lamis through the evolution of Republican appeals to racism: “You start out in 1954 by saying, ‘N_gger, n_gger, n_gger.’ By 1968 you can’t say ‘n_gger’—that hurts you. Backfires. So you say stuff like forced busing, states’ rights, and all that stuff. You’re getting so abstract now [that] you’re talking about cutting taxes, and all these things you’re talking about are totally economic things and a byproduct of them is [that] blacks get hurt worse than whites. And subconsciously maybe that is part of it. I’m not saying that. But I’m saying that if it is getting that abstract, and that coded, that we are doing away with the racial problem one way or the other. You follow me—because obviously sitting around saying, ‘We want to cut this,’ is much more abstract than even the busing thing, and a hell of a lot more abstract than ‘N_gger, n_gger.’” Atwater will go on to manage the 1988 presidential campaign of George H. W. Bush, where he will oversee the use of what is considered one of the most overtly racist campaign ads in modern history, the “Willie Horton” ad (see September 21 - October 4, 1988). The Dartmouth Review, a conservative weekly student newspaper funded by off-campus right-wing sources (see 1980), runs an article opposing affirmative action that many feel is blatantly racist. The article is titled “Dis Sho’ Ain’t No Jive, Bro,” written by former Review chairman Keeney Jones. The article is the third in a series of attacks on affirmative action by Jones; the earlier articles featured Jones wishing he could medically darken his skin so he could get into medical school, and his claim that he was taking speech lessons to learn how to speak “black.” This article is written entirely in Jones’s version of “black dialect,” and features the following selection: “Dese boys be sayin’ dat we be comin’ to Dartmut’and not takin’ the classics. You know, Homa, Shakesphere; but I hes’ dey all be co’d in da gound, six feet unda, and whatcha be askin’ us to learn from dem? We culturally ‘lightened, too. We be takin’ hard courses in many subjects, like Afro-Am studies, women’s studies, and policy studies. And who be mouthin’ ‘bout us not bein’ good road? I be practicly knowin’ ‘Roots’ cova to cova, ‘til my mine be boogying to da words! And I be watchin’ the Jeffersons on TV ‘til I be blue in da face.” Upon receiving the article, Review board member Jack Kemp (R-NY), a Republican congressman, resigns from the board, saying Kenney’s article “relied on racial stereotypes” and undoubtedly offended many readers. “I am even more concerned that others found in it some support for racist viewpoints,” Kemp continues, and concludes: “I do not want my name to appear in your paper. I am concerned that the association of my name with the Dartmouth Review is interpreted as an endorsement and I emphatically do not endorse the kind of antics displayed in your article.” The Review appears unmoved by Kemp’s resignation, with editors saying they hope to replace him with televangelist Jerry Falwell. Editor Dinesh D’Souza says the paper bears no responsibility for any allegations of racism, and tells a New Hampshire reporter, “It is not the Dartmouth Review but the Afro-American Society which is the primary cause of racial tension on campus.” The undergraduate council and the faculty later votes to condemn the Review for creating a racially divisive atmosphere; Dartmouth’s president will write a letter saying the Review performs “offensive practices,” but that the issue cannot be solved by “violence or intolerance.” [Dartmouth Free Press, 9/20/2006]

[Source: Exiled Online (.com)]The Dartmouth Review, a conservative weekly student newspaper funded by off-campus right-wing sources (see 1980), publishes a satirical piece called “Grin and Beirut,” that compares an Israeli settlement in West Beirut to a temporary structure just erected by Jewish students at Dartmouth to celebrate the harvest and saying it was built on “the West Bank of College Hall.” The structure, known as a sukkah, is where the students gather for meals during the eight-day Succoth holiday. “The Zionists have gone too far with the erection of a ceremonial ‘sukkah’ settlement on the West Bank of College Hall,” the Review writes. Two days later, unidentified vandals destroy the structure. Many Dartmouth students and faculty members believe the Review’s apparent anti-Semitism incited the vandalism, including a rabbi with the university. Even the conservative Manchester Union-Leader, one of New Hampshire’s staunchest press supporters of the Review, criticizes the Review for its writings. One of the article’s co-authors says he regrets writing the piece, and the Review publishes an apology saying that it is “committed to fighting not only vandalism but also the psychological bigotry that can precipitate it.” [Boston Globe, 10/5/1990; Dartmouth Free Press, 9/20/2006] In 2006, the Dartmouth Free Press will write that Review staffers may have destroyed the sukkah. The reporter will note that any contrition or commitment to “fighting vandalism [and] psychological bigotry” was not in evidence in later years, when Review staffers used sledgehammers to destroy shanties built by students as part of protests against apartheid in South Africa. Beginning in the mid-1980s, Schweitzer moves toward becoming an anti-government tax resister. He becomes fascinated by the legal ideology of the Posse Comitatus (see 1969), attends numerous Posse meetings, and has some contacts with members of The Order (see Late September 1983). Schweitzer, well-liked by his neighbors and friends, begins to worry them with his increasing extremism. He helps a friend, Bernard Kuennan, mount a legal defense against charges of letting his dog roam unvaccinated, and the two hammer the judge with questions about the differences between “admiralty” and “common law” (see Fall 2010). He defies police officers who stop him for traffic violations. He moves to Montana, where he refuses to get a license to fly his Cessna crop duster, resulting in federal arrest warrants. His refusal to pay federal taxes causes the IRS to seize his plane in November 1992, his Bozeman, Montana home, and other equipment, and sell it all to pay his $389,000 delinquent tax bill, dating back to the 1970s. Thoroughly radicalized, Schweitzer meets Rodney Owen Skurdal, another legal manipulator. Skurdal is an ex-Marine and Posse Comitatus advocate who, during litigation of a worker’s compensation suit in the 1980s, tells the judge that the federal government lacks the authority to print paper money and demands, fruitlessly, to be paid his compensation in gold bullion. One Wyoming newspaper claims that Skurdal’s extremism begins after he suffers a fractured skull in 1983, the source of the compensation claim; Skurdal’s former wife says after the injury that Skurdal refuses to use a Social Security number or driver’s license. Skurdal, like many in the Posse, is an adherent to the virulently racist Christian Identity belief system (see 1960s and After), and in court filings claims non-whites are “beasts,” and Jews “the children of Satan.” Skurdal routinely intertwines Identity, Posse Comitatus, Biblical, and Uniform Commercial Code (UCC) tenets in his court filings (see 1994). In 1993, the IRS seizes his farm near Roundup, Montana, for back taxes; Skurdal continues to occupy the farm and no local official dares to evict him. In late 1994, Skurdal invites Schweitzer to move in with him; they are joined by Daniel Petersen in early 1995. The three become the nucleus of what will become the Montana Freemen. Skurdal’s farm becomes a headquarters for the nascent organization, with computers, fax machines, laser printers, and satellite dishes going round the clock. The inhabitants post a sign on the edge of the property, reading: “Do Not Enter Private Land of the Sovereign.… The right of Personal Liberty is one of the fundamental rights guaranteed to every citizen, and any unlawful interference with it may be resisted.” Local authorities want to curb the group, but do not want to risk violence and bloodshed. Musselshell County Sheriff G. Paul Smith says: “These people want to be martyrs. I don’t know how far they are willing to carry that.” Moreover, Smith and his small sheriff’s department are outnammed and outgunned. [Mark Pitcavage, 5/6/1996]

[Source: Greater Houston Pachyderm Club]The billionaire Koch brothers, Charles and David, launch the first of a number of “citizen advocacy” groups they either found or fund, Citizens for a Sound Economy. The Kochs are staunch right-wing libertarians determined to successfully combat government regulation and oversight of businesses, government taxation, and government funding of social programs (see August 30, 2010). Between 1986 and 1993, the brothers will provide $7.9 million to the group, even as it promotes itself as a “grassroots,” “citizen-driven” organization. (Such organizations that call themselves “citizen-based” while actually being founded, operated, and funded by corporate interests are called “astroturf” organizations.) Matt Kibbe, who will go on to head a Koch-funded lobbying organization, FreedomWorks, will later say of Citizens for a Sound Economy that its driving force was to take the Kochs’ “heavy ideas and translate them for mass America.… We read the same literature Obama did about nonviolent revolutions—Saul Alinsky, Gandhi, Martin Luther King. We studied the idea of the Boston Tea Party as an example of nonviolent social change. We learned we needed boots on the ground to sell ideas, not candidates.” One organization participant will say that the brothers are “very controlling, very top down. You can’t build an organization with them. They run it.” By 1993, the organization will become powerful enough to successfully thwart the Clinton administration’s efforts to place a “BTU tax” on energy, and mounts successful “citizen protests” against Democrats, sometimes funnelling millions of Koch monies into the political campaigns of their Republican opponents. [Source: Media Research Center]Roger Ailes, a former media consultant to the Nixon administration (see Summer 1970), comes up with a bold plan to help his new client, Vice President George H.W. Bush, who is running for president. Bush is neck-deep in the Iran-Contra scandal (see Before July 28, 1986, August 6, 1987, and December 25, 1992) and, as reporter Tim Dickinson will later write, comes across as “effete” in comparison to his predecessor Ronald Reagan. Ailes decides to use an interview with combative CBS News reporter Dan Rather to bolster his client’s image. Ailes insists that the interview be done live, instead of in the usual format of being recorded and then edited for broadcast. Dickinson will later write, “That not only gave the confrontation the air of a prizefight—it enabled Ailes himself to sit just off-camera in Bush’s office, prompting his candidate with cue cards.” Rather is in the CBS studio in New York and has no idea Ailes is coaching Bush. As planned, Bush begins the interview aggressively, falsely accusing Rather of misleading him by focusing the interview on Iran-Contra. (It is true that CBS had not informed the Bush team that it would air a report on the Iran-Contra investigation as a lead-in to the Bush interview, a scheduling that some in the Bush team see as a “bait-and-switch.”) When Rather begins to press Bush, Ailes flashes a cue card: “walked off the air.” This is a set piece that Bush and Ailes have worked out beforehand, based on an embarrassing incident in Rather’s recent past, when Rather angrily walked off the CBS set after learning that his newscast had been pre-empted by a women’s tennis match. Clenching his fist, Ailes mouths at Bush: “Go! Go! Just kick his ass!” Bush fires his rejoinder: “It’s not fair to judge my whole career by a rehash on Iran. How would you like it if I judged your career by those seven minutes when you walked off the set?” In their 1989 book The Acting President: Ronald Reagan and the Supporting Players Who Helped Him Create the Illusion That Held America Spellbound, CBS host Bob Schieffer and co-author Gary Paul Gates will write: “What people in the bureau and viewers at home could not see was that the response had not been entirely spontaneous. As the interview progressed, the crafty Ailes had stationed himself beside the camera. If Bush seemed to be struggling for a response, Ailes would write out a key word in huge letters on his yellow legal pad and hold it just beneath the camera in Bush’s line of vision. Just before Bush had shouted that it was not fair to judge his career on Iran, Ailes had written out on his legal pad the words.… Three times during the interview, Bush’s answer had come after Ailes had prompted him with key words or phrases scribbled on the legal pad.” Dickinson will later write: “It was the mother of all false equivalencies: the fleeting petulance of a news anchor pitted against the high crimes of a sitting vice president. But it worked as TV.” Ailes’s colleague Roger Stone, who worked with Ailes on the 1968 Nixon campaign, will later say of the interview: “That bite of Bush telling Rather off played over and over and over again. It was a perfect example of [Ailes] understanding the news cycle, the dynamics of the situation, and the power of television.” [Associated Press, 7/6/1989; NewsBusters, 1/25/2008; Rolling Stone, 5/25/2011] After the interview is concluded, Bush leaps to his feet and, with the microphone still live, says: “The b_stard didn’t lay a glove on me.… Tell your g_ddamned network that if they want to talk to me to raise their hands at a press conference. No more Mr. Inside stuff after that.” The unexpected aggression from Bush helps solidify his standing with hardline Republicans. The interview gives more “proof” to those same hardliners that the media is hopelessly liberal, “their” candidates cannot expect to be treated fairly, and that the only way for them to “survive” encounters with mainstream media figures is through aggression and intimidation. [Salon, 1/26/2011] Conservative commentator Rich Noyes will write in 2008 that Bush’s jab at Rather exposed the reporter’s “liberal bias,” though he will fail to inform his readers of Ailes’s off-camera coaching. The Bush presidential re-election campaign, trailing Democratic challenger Michael Dukakis, the governor of Massachusetts, in the polls, decides on a “two-track” campaign strategy. The strategy is crafted by campaign manager Lee Atwater. The “high road” track will be taken by President Bush and the campaign directly, attacking Dukakis’s record on law enforcement and challenging his reputation as having led Massachusetts into a period of economic growth (the so-called “Massachusetts Miracle”). The “low road,” designed by Atwater to appeal to the most crude racial stereotypes (see 1981), is to be taken by ostensibly “independent” voter outreach organizations. Because of a loophole in campaign finance rules, the Bush campaign could work closely with “outside groups” and funnel money from “independent” organizations to the outside groups, while denying any connections with those groups were they to run objectionable or negative political ads. Atwater wants to avoid a potential backlash among voters, who may turn against the campaign because of their antipathy towards “attack politics.” Atwater and his colleagues determine that the outside groups will use “brass knuckle” tactics to attack Dukakis, and because the ads come from these “independent” organizations, the Bush campaign can distance itself from the groups and even criticize them for being too negative. In 1999, InsidePolitics.org will write: “In so doing, Bush’s presidential effort would train a generation of campaign operatives how to run a negative campaign. Its ‘two-track’ approach would become a model of how to exploit campaign finance laws and use outside groups to deliver hard-hitting messages on behalf of the candidate. Over the course of the following decade, this strategy would become commonplace in American elections.” The idea of “outsourcing” attack ads had been popularized by the 1980 Reagan presidential campaign, which used what it called “independent expenditures” to finance “outside” attacks on its Democratic opponent, President Jimmy Carter. In 1988, “independent” conservative groups spend $13.7 million on the Bush campaign, most of which goes towards attacks on Dukakis. In comparison, progressive and liberal groups spend $2.8 million on behalf of Dukakis—an almost five-to-one discrepancy. Most of the outside money is spent on television advertising. InsidePolitics will write, “Increasingly, candidates were discovering, electoral agendas and voter impressions could be dominated through a clever combination of attack ads and favorable news coverage.” [Inside Politics (.org), 1999] The result of Atwater’s “two-track” strategy is the “Willie Horton” ad, which will become infamous both for its bluntly racist appeal and its effectiveness (see September 21 - October 4, 1988). An earlier “independent” ad attacking Dukakis’s environmental record provides something of a template for the Horton ad campaign. The so-called “Boston Harbor” ad, which depicted garbage floating in the body of water, challenged Dukakis’s positive reputation as a pro-environmental candndate. The ad helped bring Dukakis’s “positives” down, a strong plus for Bush, whose record as an oil-company executive and reputation as a powerful political friend to the oil companies hurts him in comparison with Dukakis. In July 1988, Readers Digest, a magazine known for its quietly conservative slant, publishes a profile of Horton titled “Getting Away With Murder.” The Bush campaign reprints the article and distributes it by the tens of thousands around the country. Bush presidential campaign appears, running on televisions around the country between September 21 and October 4, 1988. Called “Weekend Pass,” it depicts convicted murderer William “Willie” Horton, who was granted 10 separate furloughs from prison, and used the time from his last furlough to kidnap and rape a young woman. The advertisement and subsequent media barrage falsely accuses Democratic presidential candidate Michael Dukakis, the governor of Massachusetts, of creating the “furlough program” that led to Horton’s release, and paints Dukakis as “soft on crime.” It will come to be known as one of the most overly racist political advertisements in the history of modern US presidential politics.
Ad Content - The ad begins by comparing the positions of the two candidates on crime. It notes that Bush supports the death penalty for convicted murderers, whereas Dukakis does not. The ad’s voiceover narrator then states, “Dukakis not only opposes the death penalty, he allowed first-degree murderers to have weekend passes from prison,” with the accompanying text “Opposes Death Penalty, Allowed Murderers to Have Weekend Passes” superimposed on a photograph of Dukakis. The narrator then says, “One was Willie Horton, who murdered a boy in a robbery, stabbing him 19 times,” accompanied by a mug shot of Horton. The voiceover continues: “Despite a life sentence, Horton received 10 weekend passes from prison. Horton fled, kidnapped a young couple, stabbing the man and repeatedly raping his girlfriend.” At this point, the ad shows another picture of Horton being arrested while the accompanying text reads, “Kidnapping, Stabbing, Raping.” The ad’s narration concludes: “Weekend prison passes. 'Soft on Crime' - The ad is a reflection of the measures the Bush campaign is willing to undertake to defeat the apparently strong Dukakis candidacy. Dukakis is a popular Democratic governor and widely credited with what pundits call the “Massachusetts Miracle,” reversing the downward economic spiral in his state without resorting to hefty tax increases. At the time of the ad, Dukakis enjoys a 17-point lead over Bush in the polls. Bush campaign strategists, led by campaign manager Lee Atwater, have learned from focus groups that conservative Democratic voters, which some call “Reagan Democrats,” are not solid in their support of Dukakis, and are swayed by reports that he vetoed legislation requiring teachers to say the Pledge of Allegiance at the beginning of the school day. They also react negatively when they learn that during Dukakis’s tenure as governor, Horton had been furloughed and subsequently raped a white woman. Atwater and the Bush campaign decide that Dukakis can successfully be attacked as a “liberal” who is “not patriotic” and is “soft on crime.” Atwater, who has a strong record of appealing to racism in key voting groups (see 1981), tells Republican Party officials, “By the time this election is over, Willie Horton will be a household name.” Although Dukakis had vetoed a bill mandating the death penalty for first-degree murder in Massachusetts, he did not institute the furlough program; that was signed into law by Republican governor Francis Sargent in 1972. The ads and the accompanying media blitz successfully avoid telling voters that Sargent, not Dukakis, instituted the furlough program. [Regardie's Magazine, 10/1/1990; Inside Politics (.org), 1999]
Running the Horton Ad - The ad is sponsored by an ostensibly “independent” political organization, the conservative National Security Political Action Committee (NSPAC), headed by former Chairman of the Joint Chief of Staff Thomas Moorer. NSPAC’s daughter organization “Americans for Bush” actually put together the ad, created by marketer Larry McCarthy in close conjunction with Atwater and other Bush campaign aides; Atwater determined months before that the Horton ad should not come directly from the Bush campaign, but from an “independent” group supporting Bush, thus giving the Bush campaign the opportunity to distance itself from the ad, and even criticize it, should voters react negatively towards its message (see June-September 1988). The first version of the ad does not use the menacing mug shot of Horton, which McCarthy later says depicts “every suburban mother’s greatest fear.” McCarthy and Atwater feared that the networks would refuse to run the ad if it appeared controversial. However, the network censors do not object, so McCarthy quickly substitutes a second version of the ad featuring the mug shot. When Democrats and progressive critics of the Bush campaign complain that Bush is running a racist ad, Bush media adviser Roger Ailes says that neither he nor the campaign have any control over what outside groups like “Americans for Bush” put on the airwaves. InsidePolitics will later write, “This gave the Bush camp plausible deniability that helped its candidate avoid public condemnation for racist campaigning.”
Accompanying Newspaper Reports, Bush Campaign Ads - The ad airs for the first time on September 21. On September 22, newspapers around the nation begin publishing articles telling the story of Angie and Clifford Barnes, victimized by Horton while on furlouogh. On October 5, the Bush campaign releases a “sister” television ad, called “Revolving Door.” Scripted by Ailes, the commercial does not mention Horton nor does it show the now-infamous mug shot, but emphasizes the contention that Dukakis is “soft on crime” and has what it calls a “lenient” furlough policy for violent convicts. The central image of the ad is a stream of African-American inmates moving slowly in and out of a revolving gate. The voiceover says that Dukakis had vetoed the death penalty and given furloughs to “first-degree murderers not eligible for parole. While out, many committed other crimes like kidnapping and rape.” At the same time, Clifford Barnes and the sister of the youth murdered by Horton embark on a nationwide speaking tour funded by a pro-Bush independent group known as the Committee for the Presidency. Barnes also appears on a number of television talk shows, including those hosted by Oprah Winfrey and Geraldo Rivera. Barnes and the victim’s sister also appear in two “victim” ads, where Barnes says: “Mike Dukakis and Willie Horton changed our lives forever.… We are worried people don’t know enough about Mike Dukakis.” In 1999, InsidePolitics will write that the media gives the “Revolving Door” ad a “courteous reception,” and focuses more on the two ads’ impact on the election, and the Dukakis campaign’s lack of response, instead of discussing the issues of race and crime as portrayed by the ads. It is not until October 24, less than two weeks before the election, that anyone in the mainstream media airs footage of critics questioning whether the ads are racially inflammatory, but these appearances are few and far between, and are always balanced with appearances by Bush supporters praising the campaign’s media strategy. Denials - Bush and his vice presidential candidate Dan Quayle will deny that the ads are racist, and will accuse Democrats of trying to use racism to stir up controversy (see October 1988).
Failure to Respond - The Dukakis campaign will make what many political observers later characterize as a major political blunder: it refuses to answer the ads or dispute their content until almost the last days of the campaign, hoping that viewers would instead conclude that the ads are unfair without the Dukakis campaign’s involvement. The “Willie Horton” ad campaign, a pair of ads launched by an “independent” organization on behalf of the Bush re-election campaign and by the Bush campaign itself (see June-September 1988 and September 21 - October 4, 1988), is considered an immediate success by veteran political observers, in spite of what many call its overtly racist appeal. Because the first ad, “Weekend Pass,” was the product of an ostensibly independent organization, the Bush campaign is able to keep a distance between itself and the ad. In the last weeks of the campaign, some polls show that voters blame President Bush and Democrat Michael Dukakis almost equally for the negative tone of the campaign. While the ads only ran a relatively small number of times, news networks run the ads repeatedly, often adding their own analysis while the images of the ads run in the background. According to InsidePolitics, only once does any journalist challenge the “deceptive information from Bush’s crime ads.… By amplifying Bush’s claims, news reporters gave the ads even greater legitimacy than otherwise would have appeared. News accounts quoted election experts who noted that Bush’s tactics were effective and that Dukakis’ failure to respond was disastrous. Because these assessments appeared in the high credibility framework of news broadcasts, they came across as more believable than had they been aired only as paid advertisements.” The “Weekend Pass” and “Revolving Door” ads have a palpable effect on the electorate, energizing voters who cite “law and order” as one of their major concerns for the nation, and driving many of them towards voting for Bush. Less discussed but equally powerful is the racial effect of the ads. Polls show that many white voters feel fearful because of the ads, and feel that Bush, not Dukakis, will make them safer from crime. InsidePolitics notes that the Bush campaign “had picked the perfect racial crime, that of a black felon raping a white woman.” Later research will show that many viewers saw the Horton case as more about race than crime; many subjects exposed to news broadcasts about the Horton case responded in racial terms, with studies finding that the ads “mobilized whites’ racial prejudice, not their worries about crime.” InsidePolitics will write: “Viewers became much more likely to feel negatively about blacks in general after having heard the details of the case. It was an attack strategy that worked well on several different levels for Republicans.” [Inside Politics (.org), 1999; University of Virginia, Introduction to American Politics, 11/18/2009] After the election, a New York Times voter poll will rate the “Revolving Door” ad as the single most influential ad of the campaign. The ad was particularly effective among white women, many of whom said that after watching it during the campaign, they began to view Bush as “stronger on crime” and as the candidate who would keep them “safer.” In 1999, InsidePolitics will write that voters often conflated the two ads, and it is unclear from poll responses whether they differentiated between the independently produced ad and the Bush campaign ad. InsidePolitics also notes the powerful impact of the Horton ad’s clear reference to rape. Dukakis’s campaign manager Susan Estrich will say: “The symbolism was very powerful… you can’t find a stronger metaphor, intended or not, for racial hatred in this country than a black man raping a white woman.… I talked to people afterward.… Women said they couldn’t help it, but it scared the living daylights out of them.” [Inside Politics (.org), 1999]

The “Willie Horton” (a.k.a. “Weekend Pass”) campaign ad, produced by an “independent” political organization on behalf of the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988), and the Bush campaign’s accompanying ad, “Revolving Door,” draw accusations from the Democratic challenger, Michael Dukakis, that they are racist in their appeals. President Bush denies the accusations that race has anything to do with the ads, or even that racism exists. He calls the Dukakis accusations “some desperation kind of move,” and says: “There isn’t any racism. It’s absolutely ridiculous.” Dukakis is leveling these accusations, Bush says, because he “is weak on crime and defense and that’s the inescapable truth.” Bush accuses Dukakis of lying about his record, and accuses the Democrat of both racist and sexist behavior, though he gives no details or evidence. Bush’s vice-presidential candidate, Dan Quayle, agrees, and accuses the Dukakis campaign of behaving in a racist manner, saying: “It’s totally absurd and ridiculous. I think it shows just how desperate they really are, to start fanning the flames of racism in this country.” Civil rights leader Jesse Jackson has accused the Bush campaign of trying to incite racial fears through the Horton ad, and Dukakis’s vice-presidential candidate, Lloyd Bentsen, says there seems to be “a racial element” in the Bush campaign’s strategy. In contrast to Bush’s denials, Bush media adviser Roger Ailes jokes with reporters about the ads, saying that the campaign’s only question about the Horton ad was whether to portray Horton “with a knife in his hand or without it,” and accuses Dukakis’s campaign of spreading racism about Hispanics in its own ads. The Dartmouth Review, a conservative weekly student newspaper funded by off-campus right-wing sources (see 1980), marks the 50th anniversary of Kristallnacht, a Nazi rampage through the Jewish communities of Germany in 1938, by depicting Dartmouth College president James Freedman as Adolf Hitler on its front cover. Freedman is Jewish. The article accuses him of searching for a “final solution” to the problem of conservatives at Dartmouth, a specific reference to the Holocaust. Many Dartmouth students and faculty members accuse the Review of overt anti-Semitism (see October 1982 and October 4, 1990). Two Democratic organizations in Ohio file a complaint with the Federal Election Commission (FEC) in the matter of the now-infamous “Willie Horton” ads used to great effect by the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988). The complaint alleges that the ostensibly independent political organization that created and financed the first ad, the National Security Political Action Committee (NSPAC), violated the law on independent expenditures (see May 1990 and After). African-American writer Anthony Walton writes for the New York Times Magazine his thoughts on the overtly racist “Willie Horton” ad campaign launched the year before by the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988). Walton writes: “George Bush and his henchmen could not have invented Willie Horton. Horton, with his coal-black skin; huge, unkempt Afro, and a glare that would have given Bull Connor or Lester Maddox [infamous white supremacists who abused African-Americans in the 1950s and ‘60s] serious pause, had committed a brutal murder in 1974 and been sentenced to life in prison. Then, granted a weekend furlough from prison, had viciously raped a white woman in front of her fiance, who was also attacked. Willie Horton was the perfect symbol of what happened to innocent whites when liberals (read Democrats) were on the watch, at least in the gospel according to post-Goldwater Republicans. Horton himself, in just a fuzzy mug shot, gave even the stoutest, most open, liberal heart a shiver. Even me. I thought of all the late nights I had ridden in terror on the F and A trains, while living in New York City. I thought Willie Horton must be what the wolf packs I had often heard about, but never seen, must look like. I said to myself, ‘Something has got to be done about these n_ggers.’” Walton recounts several instances where he himself has been the victim of racism, and notes that in many eyes, he and Horton are interchangeable: “If Willie Horton would become just a little middle-class, he would look like me.… [I]n retrospect, I can see that racism has always been with me, even when I was shielded by love or money, or when I chose not to see it. But I saw it in the face of Willie Horton, and I can’t ignore it, because it is my face.” [New York Times Magazine, 8/20/1989]

The Ohio Democratic party and a group called Black Elected Democrats of Ohio file a complaint with the Federal Election Commission (FEC) over the infamous “Willie Horton” campaign ad of 1988 (see September 21 - October 4, 1988), claiming that the “outside” organization that released the ad, the National Security Political Action Committee (NSPAC), violated the law on independent expenditures, and that NSPAC functioned as an arm of the 1988 Bush presidential campaign. According to the complaint, it was legal for NSPAC to expend funds criticizing Democratic presidential candidate Michael Dukakis and supporting President Bush’s election only if the expenditures were independent and uncoordinated between the two organizations. Any spending that was made “in cooperation, consultation, or concert, with, or at the request or suggestion of, a candidate, his authorized political committees, or their agents,” represented an illegal “in-kind contribution” in excess of federal contribution limits. The FEC conducts an investigation into the relationship between NSPAC and the Bush campaign. The investigation uncovers several ties between the two organizations. For example, Larry McCarthy, the NSPAC media consultant who, as a top marketing expert for the NSPAC’s “Americans for Bush” organization, created the Horton ad, worked for top Bush campaign adviser Roger Ailes; McCarthy was a former senior vice president of Ailes Communications, Inc. (ACI), which functioned as the main media consulting firm for the Bush campaign. McCarthy tells investigators he worked at ACI until January 1987, but continued to work with ACI on “a contractual basis” until December 1987, when he began working as Senator Robert Dole (R-KS)‘s media consultant. McCarthy admits to having a number of contacts with Ailes during the Bush-Dukakis campaign, but says some of them were “of a passing social nature,” such as “running into one another in restaurants or at airports.” He denies discussing “anything relative to the Bush presidential campaign, NSPAC, or political matters.” McCarthy’s story is contradicted by Ailes, who tells the FEC that he had talked to McCarthy twice about opportunities to work for the Bush campaign, opportunities Ailes says McCarthy lost by working for NSPAC. The FEC also discovers that another former ACI employee, Jesse Raiford of Raiford Communications, worked on the Horton ad, and while doing so “simultaneously received compensation from NSPAC and the Bush campaign.” Raiford also “expended NSPAC funds for the production of the Willie Horton ad.” Though there is clear evidence of illegal connections and complicity between the Bush campaign and NSPAC, the FEC’s Board of Commissioners deadlock 3-3 on voting whether to bring formal charges against the two organizations. The swing vote, commissioner Thomas Josefiak, says the explanations from Ailes and McCarthy about their lack of substantive contacts during the campaign “were plausible and reasonably consistent.” Josefiak says both were guilty of “bad judgment” and may have acted “foolish[ly],” but did nothing warranting legal action. The FEC also determines that Raiford only “performed technical tasks” for the two organizations, “and played no role in any substantive or strategic decisions made by either organization.” The commissioners conclude that neither organization violated campaign finance law. The crisis in the Persian Gulf, as grave as it is, also offers a rare opportunity to move toward an historic period of cooperation. Out of these troubled times, our fifth objective—a new world order—can emerge: a new era—freer from the threat of terror, stronger in the pursuit of justice, and more secure in the quest for peace.” The Southern Poverty Law Center will later write that many people, particularly white supremacists and separatists, take Bush’s phrase “as a slip of the tongue revealing secret plans to create a one-world government.” [Sweet Liberty, 9/11/1990; Southern Poverty Law Center, 6/2001] In 1995, Michigan gun dealer and right-wing activist Frank Kieltyka will describe the “New World Order” to a Buffalo News reporter. According to Kieltyka, the “New World Order” is backed by the US government and led by, among other organizations, the Trilateral Commission and the Council on Foreign Relations (CFR). “We’re moving towards the Communists,” Kieltyka will warn. The belief in this “New World Order” will be emphasized in coming years in the militia movements and by right-wing publications such as The Spotlight, an openly racist, anti-government newsletter. According to the editorial, GOPAC, the GOP Political Action Committee chaired by Representative Newt Gingrich (R-GA), has issued a glossary mailed to Republican state legislative candidates urging them to use the following words to characterize their Democratic opponents: “sick,” “traitors,” “bizarre,” “self-serving,” “shallow,” “corrupt,” “pathetic,” and “shame.” GOPAC later “regretted” including the word “traitors” in that list of characterizations, the editorial reports, but has continued to back the use of the other epithets. The glossary is part of a pamphlet entitled “Language: A Key Mechanism of Control,” and features a letter from Gingrich advising the candidates to step up the personal invective against their opponents because, he writes, vilification works. The Times writes: “Mr. Gingrich’s injunction represents the worst of American political discourse, which reached a low during the dispiriting presidential campaign of 1988 (see September 21 - October 4, 1988). Then, more than ever before, negative argument displaced reasoned discussion about how a nation might best be governed. The sound bite reigned. Attack commercials flourished. The signs this year aren’t any better. Evidence that negative campaigning can come back to sink the sender has had little impact. The races for governor in California and Texas have already seen the same slash and burn. No doubt the proceedings will grow more rabid still as November nears. Negative discourse serves democracy poorly. The temptation to avoid serious debate is already great. It increases as the stakes soar and slander becomes a rewarding, easy option. The issues of the day go untended. The whole affair takes on the character of the gladiator’s art. The GOPAC glossary may herald a descent into even lower levels of discourse. It comes blessed by a politician of some influence—the Republican whip in the House—and it is intended for candidates on the state level, many of them presumably running for the first time. Even though Mr. Gingrich himself may not have seen the list before it was mailed, this is a disturbing document. The nakedness of the GOPAC offering also makes it useful. There must be limits to the negative politics that voters will bear; the bald appeal to invective will certainly probe those limits. Almost 2,500 protesters gather on the Dartmouth College green to protest the conservative, off-campus Dartmouth Review, a student newspaper given to extremes of racial and political rhetoric (see 1980). The protest is sparked by the Review’s recent publication of a selection of Nazi propaganda on Yom Kippur, one of the highest of Jewish holy days. The selection, printed on the paper’s masthead, was from Adolf Hitler’s book Mein Kampf, and read: “I therefore believe today that I am acting in the sense of the Almighty Creator: By warding off the Jews, I am fighting for the Lord’s work.” The protest is led by Dartmouth president James Freedman, and made up of a wide swath of students, faculty, and alumni. “This has been a week of infamy for the Dartmouth community,” Freedman says. “The Dartmouth Review has consistently attacked blacks because they are black, women because they are women, homosexuals because they are homosexuals, and Jews because they are Jews,” he says; two years before, the Review had compared Freedman, who is Jewish, to Hitler, and compared his policies to the Holocaust (see November 9-10, 1988). College trustees call the Hitler publication “a criminal act of sabotage.”
Trustee Accuses University President of Using Incident to 'Incite Hatred' - The Boston Globe describes Review trustee and former editor Dinesh D’Souza, a former policy adviser in the Reagan administration, as both “contrite and combative” over the incident. D’Souza apologizes for the publishing of the Hitler selection, then moments later accuses Freedman of using the incident to incite hatred against the Review. “This case is Dartmouth’s Tawana Brawley,” he says, referring to the 1987 case of a young African-American woman who some believe falsely accused several white men of raping her. “You have a sabotage, a hoax, a dirty trick that is being ruthlessly and cynically exploited by the college leadership in order to ruin the lives of many innocent students. President Freedman has emerged as the Al Sharpton of academia.” (Sharpton, a New York pastor and civil rights leader, was one of Brawley’s most public advocates.) Protesters line up one after another to urge the college to repudiate the newspaper. Dartmouth officials say that the newspaper has damaged the college’s reputation and diminished the school’s ability to recruit top students and faculty, particularly minorities. Religion professor Arthur Hertzberg calls the Hitler quote another “act of ongoing hooliganism” in a string of politically and racially explosive actions by the Review, and tells the crowd: “This is not a hating college. This is not an anti-Semitic college. This is not an institution of infamy. It is a community of warmth and love.”
Professor: Responsibility Lies with Conservative Funders - Hertzberg says his quarrel is not with “the 20 or 30 misguided young people who edit the Review.” Rather, he says, it is with the prominent conservatives who support the paper. The Review is financed mostly by off-campus, conservative organizations and foundations; it has an annual budget of some $150,000, and faces high legal bills. Hertzberg says the paper’s key backers include former Treasury Secretary William Simon; former Chase Manhattan Bank chairman George Champion; National Review editor William F. Buckley Jr.; and conservative commentator and former Nixon speechwriter Patrick Buchanan. “My quarrel is with those out there who put up hundreds of thousands of dollars a year with which to contaminate this campus,” Hertzberg says. “They should be ashamed of themselves.”
Board Member Accuses Liberals of Planting Hitler Quote - Review advisory board member George Gilder, a conservative economist, says the Hitler quote was planted by someone who wishes the newspaper ill: “Do you think any conservative in the world would deliberately put that into the magazine? It’s obviously an attack by somebody who infiltrated the ranks.” Gilder says Freedman and liberals at Dartmouth are using the Hitler incident “to try to kill the Review, just as they try to kill conservatism whenever it rises up on campus.” Editor in chief Kevin Pritchett collects the issues of the newspaper, and, with three other senior staffers, publishes an open letter denying any involvement in publishing the quote and accusing a staff “insider” of somehow inserting it. Review supporters in New York and Washington, DC, demand that the Anti-Defamation League (ADL) conduct an investigation to find the “saboteur,” and Review adviser Jeffrey Hart releases a written response that attacks Freedman for falsely accusing the Review of racism (see March 15, 1982, 1983, and August 2002) and intolerance (see 1981, 1984, 1985, and July 1990). [Boston Globe, 10/5/1990; Dartmouth Free Press, 9/20/2006] Days later, Simon publishes an editorial in the New York Times decrying the Review’s reference to Hitler, but calling the publication of the quote “sabotage” and saying: “[s]omeone secretly gained access to the production process.… Since the slur was deviously implanted in a section that remains unchanged from week to week, the subterfuge eluded the proofreaders.” He describes Pritchett as “horrified” by the incident, says that any accusations of anti-Semitism on the Review’s part are “preposterous,” and accuses Freedman of orchestrating a protest against the Review “that quickly metamorphosed into an instrument of hate—hate directed against student journalists who, as a result, suffered death warnings, threats of violence, as well as mean-spirited accusations.” The Review serves to “question, challenge, and even deride the dominant liberal orthodoxy on the campus, exposing its hypocrisies,” Simon writes, and calls any attempt to call the Review to account “political opportunism.” [New York Times, 10/20/1990]
Investigation Finds Quote Included by Staff, Editors - The ADL will indeed conduct an investigation, and will find that the Hitler quote was from a well-thumbed book in the Review’s office. It will conclude that a Review staffer had inserted the quote with the knowledge and apparent complicity of the senior editors. The ADL will call the publication of the quote “obviously an anti-Semitic act,” and write, “Prior acts of the Review and the past conduct of its members have contributed, the commission believes, to the creation of an environment which condoned and even encouraged a member of the Review to include the offensive Hitler quote.” The investigation notes that the Review has frequently published other offensive comments such as “the only good Indian is a dead Indian” and “genocide means never having to say you’re sorry.”
History of Anti-Semitism - The Review has a history of anti-Semitic publishings (see October 1982 and November 9-10, 1988). D’Souza says Review trustees have repudiated such actions, which he calls the work of unpolished and overzealous staffers who sometimes run the Review like “a half-baked, ramshackle student paper.”
Review President, Contributors Resign over Furor - C. Tyler White, president of the Review, will soon resign in protest. “I cannot allow the Review to ruin my life any further,” he will write. “The official Review response, which I co-signed and helped distribute, avoids the main thrust of the issue. It does not emphasize our sorrow in this dreadful act of malice, nor does it claim responsibility for letting it reach newsprint.… The editor in chief has failed in his job, and now we must wear the albatross of anti-Semitism because he won’t take responsibility for the issue’s contents.” Review contributors David Budd and Pang-Chun Chen resign along with White, writing, “We are conservatives, but we are not Nazis.” Budd writes that the Review’s apology implied “let’s put the blame on someone else.”
Congressional Involvement - US Representative Chester Atkins (D-MA) delivers a letter concerning the incident to Freedman, accusing the Review of “fomenting hatred and intolerance.” The letter is signed by 84 of Atkins’s fellow Congress members. Atkins is running for re-election against a Review board member, John MacGovern. Atkins says MacGovern should step down as a board member; MacGovern refuses, saying the Review’s senior editors are not responsible for the Hitler quote. Anita Hill.Anita Hill. [Source: ABC News]Clarence Thomas’s Senate confirmation hearings for the Supreme Court (see October 13, 1991) are muddied by explosive charges of sexual harassment. Anita Hill, a conservative, African-American law professor who once worked for Thomas both at the Department of Education and at the Equal Employment Opportunity Commission (EEOC), testifies before the Senate Judiciary Committee about Thomas’s alleged sexual advances towards her. The committee learned of the allegations from one of Hill’s close friends, who says that Hill was the victim of frequent and pernicious sexual harassment by Thomas. The committee has investigated Hill’s claims, but until now, the reticent Hill has been unwilling to come forward publicly and make the charges. (The FBI is conducting an investigation of the charges as well, though the investigation will be inconclusive.) After the story breaks in the press on October 6, committee members persuade her to come forward and lodge formal charges with the committee, thus allowing them to make her allegations public. The committee opens a second round of hearings to determine the accuracy of Hill’s charges. Hill’s testimony before the committee is calm and lethally specific. [Dean, 2007, pp. 146-153]
Testimony - Hill tells the committee: “I am not given to fantasy. This is not something I would have come forward with if I was not absolutely sure of what I was saying.” Hill testifies: “He spoke about acts that he had seen in pornographic films involving such matters as women having sex with animals, and films showing group sex or rape scenes. He talked about pornographic materials depicting individuals with large penises or large breasts involved in various sex acts. On several occasions Thomas told me graphically of his own sexual prowess.” He also “referred to the size of his own penis as being larger than normal” and spoke of the pleasure he had “given to women with oral sex.” Thomas spoke of his fondness for films depicting sex with animals, and of his particular fondness for one actor known as “Long Dong Silver.” Her last encounter with Thomas was in 1983, when, on her last day as an employee at the EEOC, she agreed to go to dinner with him after he “assured me that the dinner was a professional courtesy only.” She adds: “He made a comment I vividly remember.… He said that if I ever told anyone of his behavior, that it would ruin his career.” Judith Resnick, a law professor at the University of Southern California Law Center, says of Hill’s testimony, “You’re seeing a paradigm of a sexual-harassment case.” Asked why she is testifying now after so many years of silence, Hill says: “I have nothing to gain here. This has been disruptive of my life, and I’ve taken a number of personal risks.” She says she has been threatened, though she does not elaborate on the alleged threat. She concludes: “I have not gained anything except knowing that I came forward and did what I felt that I had an obligation to do. That was to tell the truth.” [Time, 10/21/1991] Thomas will vehemently deny the charges (see October 11-12, 1991), and his conservative supporters will smear Hill in the hearings (see October 8-12, 1991).

[Source: MSNBC]Supreme Court nominee Clarence Thomas (see October 13, 1991) responds to charges of sexual harassment from a former employee, law professor Anita Hill (see October 8, 1991). Thomas denies the charges, calling them a “travesty” and “disgusting,” and says that “this hearing should never occur in America.” [Dean, 2007, pp. 146-153] “This is not American; this is Kafkaesque. It has got to stop. It must stop for the benefit of future nominees and our country. Enough is enough.” [Time, 10/21/1991] He accuses the committee of concocting the story out of whole cloth, and says: “The Supreme Court is not worth it. No job is worth it. I’m not here for that.…This is not an opportunity to talk about difficult matters privately or in a closed environment. This is a circus. It’s a national disgrace. And from my standpoint as a black American, as far as I’m concerned, it is a high-tech lynching for uppity blacks who in any way deign to think for themselves, to do for themselves, to have different ideas, and it is a message that unless you kowtow to an old order, this is what will happen to you. You will be lynched, destroyed, caricatured by a committee of the US Senate rather than hung from a tree.” [Dean, 2007, pp. 146-153] “No job is worth what I’ve been through—no job. No horror in my life has been so debilitating. Confirm me if you want. Don’t confirm me if you are so led.… I will not provide the rope for my own lynching. These are the most intimate parts of my privacy, and they will remain just that, private.” Some observers wonder if Thomas is preparing to withdraw his nomination. But, though he says, “I would have preferred an assassin’s bullet to this kind of living hell,” he insists he would “rather die than withdraw.” [Time, 10/21/1991] While Thomas’s denials, and counter-charges of racism, are powerful, and make a tremendous impression on reporters, there are several fundamental flaws with his statement. The denial was not, as characterized by the press, a spontaneous outpouring of outraged innocence, but a carefully written and rehearsed performance, coached by his Republican handlers. And though he responds dramatically to Hill’s charges, he admits in the hearings that he never actually watched her testimony; his wife watched portions of it and reported back to Thomas. Though he denies Hill’s allegations that he asked her out for dates several times, and initially denies ever having any contact with her outside of work, he admits later in the hearings that he drove her home several times and stayed to discuss politics over “a Coke or a beer.” He admits that on “several instances” he visited her home outside of work entirely. Finally, the evidence gathered by the committee, and by researchers after Thomas’s ascension to the Court, overwhelmingly supports Hill’s allegations. Thomas never presents a shred of evidence to refute her charges. [Time, 10/21/1991; Dean, 2007, pp. 146-153]

White supremacist Timothy McVeigh (see March 24, 1988 - Late 1990 and November 1991 - Summer 1992) closely follows the culminating events of the Ruby Ridge, Idaho, siege (see August 31, 1992). McVeigh is appalled by the government’s conduct, as is his friend Terry Nichols, with whom he is staying (see Summer 1992). [Douglas O. Linder, 2001; CNN, 12/17/2007] McVeigh has been closely following the events at Ruby Ridge since the siege began in April 1992, both in local newspapers and in publications such as the National Rifle Association’s American Hunter and the racist, separatist Spotlight, and will complain that the mainstream media gives only the government’s version of events. He will later recall this as a “defining moment” in his life. On this show, Limbaugh gives his response to African-American filmmaker Spike Lee’s recommendation that African-American children be allowed to skip school to watch his biographical docudrama Malcolm X: “Spike, if you’re going to do that, let’s complete the education experience. Radio personality Rush Limbaugh hosts his own late-night television show; Roger Ailes, the Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988), is Limbaugh’s executive producer. On this show, Limbaugh notes a recent comment of Senator Strom Thurmond (R-SC), who told a gay solder that his lifestyle was “not normal” and advised the soldier to get psychiatric help. Thurmond, who ran for president in 1948 on an explicitly racist, segregationist third-party platform and who led the “Dixiecrat” exodus of Southern racists out of the Democratic Party (see March 12, 1956 and After), is praised by Limbaugh. The commentator says of Thurmond: “He is not encumbered by trying to be politically correct. He’s not encumbered by all of the—the so-called new niceties and proprieties. He just says it, and if you want to know what America used to be—and a lot of people wish it still were—then you listen to Strom Thurmond.… He got a standing ovation. Now people—people applauded that. People applaud—because—you know, Strom Thurmond can say it because he’s 90 years old and people say: ‘Ah, he’s just an old coot. He’s from the old days,’ and so forth. But that’s what most people think. They just don’t have the guts to say it. Betsy McCaughey.Betsy McCaughey. [Source: Newsday / Gawker (.com)]Elizabeth “Betsy” McCaughey (R-NY), a lawyer and future lieutenant governor of New York, writes a scathing analysis of the Clinton administration’s health care reform plan. The article, “No Exit,” is published in the New Republic, and sparks not only a detailed rebuttal from the Clinton administration, but numerous editorials and responses praising the article and joining in the attack. Echoing McCaughey’s arguments, Newsweek writes, “The plan would reduce the quantity and quality of health care and medical technologies by vastly expanding government’s coercive role.” McCaughey and Newsweek question the proposed creation of a seven-member “National Health Board” which will, she claims, “guess the nation’s health care needs and decree how much the nation may spend meeting them.” According to Newsweek: “Everyone would be locked into one system of low-budget health plans picked by the government. Fifteen presidential appointees, the National Quality Management Council, not you and your doctor, would define the ‘medically necessary’ and ‘appropriate’ care a doctor could give you. Escaping government control to choose your doctor or buy other care would be virtually impossible. Doctors could be paid only by the government-approved plans, at rates set by the government. It would be illegal for doctors to accept money directly from patients, and there would be 15-year jail terms for people driven to bribery for care they feel they need but the government does not deem ‘necessary.’ Government would define a minimum level of care and herd people in particular regions into dependence on the lowest-cost organization able to deliver that level. Doctors would be driven into organizations in which they would be punished financially for giving more treatment than the organizations’ budget targets permit. The primary care physician assigned to you would be, McCaughey notes, a gatekeeper with an incentive to limit your access to specialists and high-tech medicine. The premise of the Clintons’ plan is not just that government knows best, but that government knows everything relevant, including how many specialists there should be no more than 45 percent of all doctors [sic]. McCaughey says many medical students will be told that the specialties they prefer are closed, or closed to them because they are not the right race or ethnicity. Yes, the plan subordinates medical values to ‘diversity.’” Prescription drug prices would be controlled through the Department of Health and Human Services, and, McCaughey and Newsweek claim, would “certainly suppress research” that might benefit patients of incurable diseases and disorders. Refuting McCaughey - The Clinton administration details the “numerous factual inaccuracies and misleading statements” contained in McCaughey’s article. The administration’s response says that doctors and patients, not “government bureaucrats” or a board of governors, will decide what treatments are “necessary and appropriate.” The government will not decide what treatments are, and are not, provided: “If anything, the ‘necessary and appropriate’ care provision in the bill delegates authority to the medical profession—rather than imposing further government bureaucracy between the patient and the doctor.” The plan will not block Americans from opting into private health care plans just as they do now, nor will it block doctors and hospitals from accepting payments from “non-approved” health care plans. Nor does the plan require doctors and hospitals “to report your visit to a national data bank containing the medical histories of all Americans,” as McCaughey writes. And the so-called “National Health Board” will not “decide how much the nation can spend on health care beginning in 1996,” as McCaughey claims. The plan will not seek to reduce quality of care in the interest of saving money, and it does not contain price controls. Instrumental in Derailing Reform - The article will later be cited by House Speaker Newt Gingrich (R-GA) as “the first decisive breaking point” in the plan’s initial support; the plan will never be implemented. The article itself will spark tremendous controversy, winning the National Magazine Award while being attacked for being fundamentally inaccurate. (In 2006, the new editor of the New Republic, Franklin Foer, will apologize for his magazine having run the article.) In 2009 McCaughey will be a fellow at the conservative Manhattan Institute and will soon join the equally conservative Hudson Institute. Both are heavily funded by health care corporations. [Source: Huffington Post]Fox News registers the slogan “fair and balanced” as a trademark for its news and opinion broadcasts. In 2008, authors Kathleen Hall Jamieson and Joseph N. Cappella will note that conservative-slanted Fox News (see October 7, 1996 and December 20, 2004) lives up, in a sense, to its promise of “fair and balanced” news and opinion by “simply inviting liberal guests—not by ensuring that their ideas will receive compatible time.” They will note, “The notion of different amounts of access is important, because we know that in highly controlled settings, mere exposure to signs and symbols produces a preference for them.” Fox disproportionately exposes its audience to conservative messages and arguments more than moderate or liberal ones. As a result, the authors observe, “[a]n audience that gravitates primarily to conservative sources whose message is consistent and repetitive is more susceptible to alternate points of view in approximately equal amounts.” The authors will continue, “Fox’s claim that Fox is unbiased because it is ‘fair and balanced’ is made with a wink and a nod.” They will quote conservative editorialist Robert Bartley of the Wall Street Journal (see January 20, 2003) and conservative financier Richard Viguerie (see July 2004) to bolster their argument. [Source: Joe Marquette / Associated Press]Representative Helen Chenoweth (R-ID), in her first two months as a member of the US House of Representatives, accuses the federal government of sending “black helicopters” filled with “armed agency officials” to terrorize Idaho citizens. Chenoweth, who has extensive contacts among area militias and will be characterized as the militia’s “best friend” in Congress (see May 2, 1995), is repeating a canard often used by far-right extremists who believe the UN and the federal government will use “black helicopters” filled with foreign troops to impose tyranny on US citizens. In a press release, Chenoweth says the federal government is violating the Idaho Constitution by using “armed agency officials and helicopters” to enforce the Endangered Species Act and other fish and wildlife regulations. The language of the press release implies that if a federal agent is armed and in Idaho, it is a violation of the Idaho Constitution. Chenoweth orders the government to immediately cease its alleged actions, and in the release, threatens Assistant Agriculture Secretary Jim Lyons by saying, “If it does not, I guarantee you I will be your worst nightmare for at least the next two years.” Chenoweth later tells a reporter, who asks about the black helicopters: “I have never seen them. But enough people in my district have become concerned that I can’t just ignore it. We do have some proof.” Brian Gorman, a spokesman for the National Marine Fisheries Service, says, “All I can say is, we have never had helicopters, have not flown them as part of any endangered-species activity, and we’ve always worked hand in glove with local officials.” [New York Times, 5/2/1995; Sierra Magazine, 5/1996]

Fox News provides 24-hour news programming alongside the nation’s only other such cable news provider, CNN. Fox executive Roger Ailes, a former campaign adviser for Richard Nixon, Ronald Reagan and George H. W. Bush (see 1968, January 25, 1988, and September 21 - October 4, 1988), envisions Fox News as a conservative “antidote” to what he calls the “liberal bias” of the rest of American news broadcasting. Ailes uses many of the methodologies and characteristics of conservative talk radio, and brings several radio hosts on his channel, including Sean Hannity and Bill O’Reilly, to host television shows. [Jamieson and Cappella, 2008, pp. 47; New York Magazine, 5/22/2011] Referring to Ailes’s campaign experience, veteran Republican consultant Ed Rollins later says: “Because of his political work, he understood there was an audience. He knew there were a couple million conservatives who were a potential audience, and he built Fox to reach them.” [New York Magazine, 5/22/2011]
Ailes Planned for Fox News as Far Back as 1970 - Ailes began envisioning a conservative news provider to counter what he considers the mainstream media’s “liberal bias” as early as 1970, when he became heavily involved with a Nixon administration plan to plant conservative propaganda in news outlets across the nation (see Summer 1970). In 1971, he headed a short-lived private conservative television news network, Television News Incorporated (TVN—see 1971-1975), which foundered in 1975 in part because of its reporters and staffers balking at reporting Ailes-crafted propaganda instead of “straight” news. Ailes told a New York Times reporter in 1991 that he was leaving politics, saying: “I’ve been in politics for 25 years. It’s always been a detour. Now my business has taken a turn back to my entertainment and corporate clients.” But Ailes misinformed the reporter. He continued to work behind the scenes on the 1992 Bush re-election campaign, providing the campaign with attack points against Democratic contender Bill Clinton (D-AR) and earning the nickname “Deep Throat” from Bush aides. Though Ailes did do work in entertainment, helping develop tabloid television programs such as The Maury Povich Show and heading the cable business news network CNBC for three years, Ailes has continued to stay heavily involved in Republican politics ever since. Ailes became involved in the creation of Fox News in early 1996 after he left NBC, which had canceled his show America’s Talking and launched a new cable news network, MSNBC, without asking for Ailes’s involvement. Fox News is owned by News Corporation (sometimes abbreviated NewsCorp), an international media conglomerate owned by conservative billionaire Rupert Murdoch. When NBC allowed Ailes to leave, Jack Welch, the chairman of NBC’s parent company General Electric, said, “We’ll rue the day we let Roger and Rupert team up.” Murdoch has already tried and failed to buy CNN, and has already begun work on crafting news programs with hard-right slants, such as a 60 Minutes-like show that, reporter Tim Dickinson will write, “would feature a weekly attack-and-destroy piece targeting a liberal politician or social program.” Dan Cooper, the managing editor of the pre-launch Fox News, later says, “The idea of a masquerade was already around prior to Roger arriving.” Eric Burns, who will work for ten years as a Fox News media critic before leaving the network, will say in 2011: “There’s your answer right there to whether Fox News is a conventional news network or whether it has an agenda. That’s its original sin.” To get Fox News onto millions of cable boxes at once, Murdoch paid hundreds of millions of dollars to cable providers to air his new network. Murdoch biographer Neil Chenoweth will later write: “Murdoch’s offer shocked the industry. He was prepared to shell out half a billion dollars just to buy a news voice.” Dickinson will write, “Even before it took to the air, Fox News was guaranteed access to a mass audience, bought and paid for.” Ailes praised Murdoch’s “nerve,” saying, “This is capitalism and one of the things that made this country great.” [New York Magazine, 5/22/2011; Rolling Stone, 5/25/2011]
Using Conservative Talk Radio as Template - In 2003, NBC’s Bob Wright will note that Fox News uses conservative talk radio as a template, saying: “[W]hat Fox did was say, ‘Gee, this is a way for us to distinguish ourselves. We’re going to grab this pent-up anger—shouting—that we’re seeing on talk radio and put it onto television.’” CBS News anchor Dan Rather will be more critical, saying that Fox is a reflection of Murdoch’s own conservative political views. “Mr. Murdoch has a business, a huge worldwide conglomerate business,” Rather says. “He finds it to his benefit to have media outlets, press outlets, that serve his business interests. There’s nothing wrong with this. It’s a free country. It’s not an indictable offense. But by any clear analysis the bias is towards his own personal, political, partisan agenda… primarily because it fits his commercial interests.” [New Yorker, 5/26/2003]
Putting Ideology Over Journalistic Ethics, Practices - Ailes, determined not to let journalists with ethical qualms disrupt Fox News as they had his previous attempt at creating a conservative news network (see 1971-1975), brought a hand-picked selection of reporters and staffers with demonstrable conservative ideologies from NBC, including business anchor Neil Cavuto and Steve Doocy, who hosts the morning talk show “Fox and Friends.” Both Cavuto and Doocy are Ailes loyalists who, Dickinson will say, owe their careers to Ailes. Ailes then tapped Brit Hume, a veteran ABC correspondent and outspoken conservative, to host the main evening news show, and former Bush speechwriter Tony Snow as a commentator and host. John Moody, a forcefully conservative ABC News veteran, heads the newsroom. Ailes then went on a purge of Fox News staffers. Joe Peyronnin, who headed the network before Ailes displaced him, later recalls: “There was a litmus test. He was going to figure out who was liberal or conservative when he came in, and try to get rid of the liberals.” Ailes confronted reporters with suspected “liberal bias” with “gotcha” questions such as “Why are you a liberal?” Staffers with mainstream media experience were forced to defend their employment at such venues as CBS News, which he calls the “Communist Broadcast System.” He fired scores of staffers for perceived liberal leanings and replaced them with fiery young ideologues whose inexperience helps Ailes shape the network to his vision. Before the network aired its first production, Ailes had a seminal meeting with Moody. “One of the problems we have to work on here together when we start this network is that most journalists are liberals,” he told Moody. “And we’ve got to fight that.” Reporters and staffers knew from the outset that Fox, despite its insistence on being “fair and balanced” (see 1995), was going to present news with a conservative slant, and if that did not suit them, they would not be at Fox long. A former Fox News anchor later says: “All outward appearances were that it was just like any other newsroom. But you knew that the way to get ahead was to show your color—and that your color was red.” The anchor refers to “red” as associated with “red state,” commonly used on news broadcasts to define states with Republican majorities. Ailes will always insist that while his network’s talk-show hosts, such as O’Reilly, Hannity, and others, are frankly conservative, Fox’s hard-news shows maintain what he calls a “bright, clear line” that separates conservative cant from reported fact. In practice, this is not the case. Before Fox aired its first broadcast, Ailes tasked Moody to keep the newsroom in line. Early each morning, Ailes has a meeting with Moody, often with Hume on speakerphone from the Washington office, where the day’s agenda is crafted. Moody then sends a memo to the staff telling them how to slant the day’s news coverage according to the agenda of those on “the Second Floor,” as Ailes and his vice presidents are known. A former Fox anchor will later say: “There’s a chain of command, and it’s followed. Roger talks to his people, and his people pass the message on down.” After the 2004 presidential election, Bush press secretary Scott McClellan will admit, “We at the White House were getting them talking points.”
Targeting a Niche Demographic - Fox New’s primary viewership defies most demographic wisdom. According to information taken in 2011, it averages 65 years of age (the common “target demographic” for age is the 18-24 bracket), and only 1.38% of its viewers are African-American. Perhaps the most telling statistics are for the Hannity show: 86% describe themselves as pro-business, 84% believe government “does too much,” 78% are “Christian conservatives,” 78% do not support gay rights, 75% are “tea party backers,” 73% support the National Rifle Association, 66% lack college degrees, and 65% are over age 50. A former NewsCorp colleague will say: “He’s got a niche audience and he’s programmed to it beautifully. He feeds them exactly what they want to hear.” Other polls from the same time period consistently show that Fox News viewers are the most misinformed of all news consumers, and one study shows that Fox News viewers become more misinformed the more they watch the network’s programming.
Ailes's Security Concerns Affect Operations, Broadcasting - Ailes is uncomfortable in his office, a second-floor corner suite in the Fox News building at 1211 Avenue of the Americas in Manhattan. His office is too close to the street for his tastes; he believes that gay activists intend to try to harm him, either by attacks from outside the building or through assaults carried out from inside. He also believes that he is a top target for al-Qaeda assassins. Ailes barricades himself behind an enormous mahogany desk, insists on having “bombproof” glass installed in the windows, surrounds himself with heavily-armed bodyguards, and carries a firearm (he has a concealed-carry permit). A monitor on his desk shows him what is transpiring outside his office door; once, when he sees a dark-skinned man wearing what he thought was Muslim garb on the monitor, he will order an immediate lockdown of the entire building, shouting, “This man could be bombing me!” The man will turn out to be a janitor. A source close to Ailes will say, “He has a personal paranoia about people who are Muslim—which is consistent with the ideology of his network.” A large security detail escorts him daily to and from his Garrison, New Jersey home to his Manhattan offices; in Garrison, his house is surrounded by empty homes Ailes has bought to enhance his personal security. According to sources close to Ailes, Fox News’s slant on gay rights and Islamist extremism is colored by Ailes’s fear and hatred of the groups.
'We Work for Fox' - Sean Wilentz, a Princeton historian and Reagan biographer, will say: “Fox News is totalized: It’s an entire network, devoted 24 hours a day to an entire politics, and it’s broadcast as ‘the news.’ That’s why Ailes is a genius. He’s combined opinion and journalism in a wholly new way—one that blurs the distinction between the two.” Dickinson will write: “Fox News stands as the culmination of everything Ailes tried to do for Nixon back in 1968. He has created a vast stage set, designed to resemble an actual news network, that is literally hard-wired into the homes of millions of America’s most conservative voters. GOP candidates then use that forum to communicate directly to their base, bypassing the professional journalists Ailes once denounced as ‘matadors’ who want to ‘tear down the social order’ with their ‘elitist, horse-dung, socialist thinking.’ Ironically, it is Ailes who has built the most formidable propaganda machine ever seen outside of the Communist bloc, pioneering a business model that effectively monetizes conservative politics through its relentless focus on the bottom line.” Former Bush speechwriter David Frum will observe: “Republicans originally thought that Fox worked for us. The Senate launches an investigation into what a minority (Democratic) report calls “an audacious plan to pour millions of dollars in contributions into Republican campaigns nationwide without disclosing the amount or source” in order to evade campaign finance laws. A shell corporation, Triad Management, is found to have paid more than $3 million for attack ads in 26 House races and three Senate races. More than half of the advertising money came from an obscure nonprofit group, the Economic Education Trust. The Senate minority report finds that “the trust was financed in whole or in part by Charles and David Koch of Wichita, Kansas” (see August 30, 2010). Many in the investigation believe that the Koch brothers paid for the attack ads, most of which aired in states where Koch Industries does business. The brothers refuse to confirm or deny their involvement to reporters. In 1998, the Wall Street Journal will confirm that a consultant on the Kochs’ payroll had been involved in the scheme. Charles Lewis of the Center for Public Integrity will describe the scandal as “historic,” explaining: “Triad was the first time a major corporation used a cutout (a front operation) in a threatening way. Koch Industries was the poster child of a company run amok.” [New Yorker, 8/30/2010]

David Bossie.David Bossie. [Source: C-SPAN]David Bossie, an investigator for Representative Dan Burton (R-IN), is fired from his position. Bossie recently leaked transcripts of prison conversations featuring former Clinton administration official Webster Hubbell, who will be convicted of defrauding clients and sentenced to prison in 2004. Bossie fraudulently edited the transcripts to have Hubbell imply that First Lady Hillary Clinton broke the law while the two worked together in an Arkansas law firm. Bossie cut out portions of Hubbell’s conversations exonerating her from any wrongdoing, and sometimes rewrote Hubbell’s words entirely. In response to the controversy, House Speaker Newt Gingrich (R-GA) says of Burton and the House Committee on Oversight and Government Reform, “I’m embarrassed for you, I’m embarrassed for myself, and I’m embarrassed for the [House Republican] conference at the circus that went on at your committee.” (In late April, Burton had called President Clinton a “scumbag,” further embarrassing Gingrich and the Republican leadership.) Bossie came to Burton’s staff from Citizens United (CU), which he joined in 1994 and soon rose to become director of government relations and communications. In 1988, as a member of Floyd Brown’s Presidential Victory Committee (PVC), Bossie helped produce the infamous Willie Horton ad (see September 21 - October 4, 1988). In 1992, as executive director of the PVC, Bossie oversaw the release of a fundraising letter accusing then-presidential candidate Bill Clinton of having an affair with an Arkansas woman, for use in an ad that falsely suggested it was the product of President Bush’s re-election campaign. Then-President Bush accused the PVC of engaging in “filthy campaign tactics,” and his son and campaign aide George W. Bush sent a letter asking donors not to give to the organization. Bossie has encouraged Burton to open an investigation into the suicide of Clinton administration aide Vince Foster (alleging that Foster was murdered as part of some unspecified White House plot, or perhaps an Israeli intelligence “black op”). While an aide to Senator Lauch Faircloth (R-NC), Bossie was found to have tried to intimidate a federal judge during a Whitewater-related investigation. Bossie has earned a reputation as a “Whitewater stalker,” combing Arkansas for “evidence” of crimes by the Clintons, and repeatedly making false and lurid allegations against the president and/or his wife. For a year, Bossie has promised that Burton’s committee would soon produce evidence of Chinese espionage and White House collusion, but any evidence of such a scandal has never been produced. A former lawyer for the Oversight Committee, John Rowley, has called Bossie’s actions “unrelenting self-promoti[on]” and challenged Bossie’s competence. Bossie says his transcripts were accurate (though the tapes of Hubbell’s conversations prove he is wrong), and blames committee Democrats for the controversy. [Source: Bush-Clinton Fraud (.com)]Fox News chairman Roger Ailes (see October 7, 1996), a Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988), chooses an unlikely reporter to anchor Fox’s election night coverage: John Prescott Ellis, a freelance Republican political adviser and the first cousin of George W. Bush (R-TX), the Republican presidential candidate. (Ellis is the son of George Herbert Walker Bush’s sister, Nancy Ellis.) Ellis was originally hired to cover the party primaries. A later study of voting patterns by the University of California will determine that in areas where voters have access to Fox News, the network’s relentless pro-Bush coverage shifts some 200,000 votes from Democrat Al Gore (D-TN) to Bush, but Ailes wants to make sure his network’s coverage is favorable to Bush, and has always had Ellis in mind for the election night anchor position, for which he specifically gives Ellis a 30-day contract. Ellis is very close to Bush’s brother Jeb Bush (R-FL), the sitting governor of Florida (“Jeb” is an acronym for his full name, John Ellis Bush). Ellis recused himself from campaign coverage in a June 1999 Boston Globe column, defending George W. Bush from allegations of cocaine use, calling the Clinton-Gore administration “morally berserk,” and telling his readers, “There is no way for you to know if I am telling you the truth about George W. Bush’s presidential campaign, because in his case, my loyalty goes to him and not to you.” Instead of this posing an ethical dilemma or being seen as a conflict of interest at Fox, Ellis is Ailes’s first and only choice to anchor the network’s election coverage. (Ailes will later tell a February 2001 House committee hearing, “We at Fox News do not discriminate against people because of their family connections”—see February 14, 2001.) [Washington Post, 11/14/2000; Salon, 11/15/2000; Observer, 11/19/2000; Associated Press, 12/11/2000; Buffalo Beat, 12/14/2000; Nation, 11/6/2006; New York Magazine, 5/22/2011] Ellis will pre-emptively call the election for Bush, sparking the Florida recount controversy and helping propel his cousin into the White House (see November 7-8, 2000). In a response to testimony in the same February 2001 House committee hearing, Joan Konner, a journalism professor who will lead a CNN-commissioned independent study of the problems in that network’s election night coverage, will call Ellis’s hiring a substantial breach of journalistic ethics and standards. “If John Ellis had, indeed, made comments stating that his loyalties to the Bush family superceded any commitment he has to his profession or his employer, then I would judge that to be not only a perceived conflict-of-interest but a real conflict-of-interest for a journalist,” she will write in a letter to Representative John Dingell (D-MI). “While that does not disqualify an individual from any position as a journalist, it would, in my judgement, disqualify that person for any decision-making role involving reporting on his relatives during an election. Often friends and relatives are hired by journalism organizations because of their connections to the newsmakers. Their access to sources makes them valuable to the organization. However, the news organization should take every precaution against placing such an individual in an assignment that could result in bias in reporting.” [House of Representatives, Committee on Energy and Commerce, 2/14/2001]

The US Supreme Court issues a ruling in Bush v. Gore (see December 11, 2000) that essentially declares George W. Bush (R-TX) the winner of the Florida presidential election, and thusly the winner of the US presidential election (see Mid-to-Late November 2000). The decision in Bush v. Gore is so complex that the Court orders that it not be used as precedent in future decisions. The 5-4 decision is split along ideological lines, with Justices Sandra Day O’Connor (see After 7:50 p.m. November 7, 2000 and (November 29, 2000)) and Anthony Kennedy, two “moderate conservatives,” casting the deciding votes. In the per curium opinion, the Court finds: “Because it is evident that any recount seeking to meet the Dec. 12 date will be unconstitutional… we reverse the judgment of the Supreme Court of Florida ordering the recount to proceed.… It is obvious that the recount cannot be conducted in compliance with the requirements of equal protection and due process without substantial additional work.” The decision says that the recounts as ordered by the Florida Supreme Court suffer from constitutional problems (see December 7-8, 2000). The opinion states that differing vote-counting standards from county to county and the lack of a single judicial officer to oversee the recount violate the equal-protection clause of the Constitution. The majority opinion effectively precludes Vice President Al Gore from attempting to seek any other recounts on the grounds that a recount could not be completed by December 12, in time to certify a conclusive slate of electors. The Court sends the case back to the Florida Supreme Court “for further proceedings not inconsistent with this opinion.” Four justices issue stinging dissents. Justice John Paul Stevens writes: “One thing… is certain. Although we may never know with complete certainty the identity of the winner of this year’s presidential election, the identity of the loser is perfectly clear. It is the nation’s confidence in the judge as an impartial guardian of the rule of law.” Justice Stephen G. Breyer adds that “in this highly politicized matter, the appearance of a split decision runs the risk of undermining the public’s confidence in the court itself.” [Per Curiam (Bush et al v. Drafting Opinions - After oral arguments concluded the day before, Chief Justice William Rehnquist said that if they were to remand the case back to Florida, that order must go out immediately in light of the approaching deadline for certification of results; Stevens quickly wrote a one-paragraph opinion remanding the case back to Florida and circulated it, though with no real hope that it would be adopted. The five conservative justices are determined to reverse the Florida decision. For the rest of the evening and well into the next day, December 12, the justices work on their opinions. Stevens prepares the main dissent, with the other three liberal justices preparing their own concurrences. Stevens and Justice Ruth Bader Ginsburg find no support whatsoever for the equal-protection argument, and say so in their writings. Justices Breyer and David Souter give the idea some weight; Souter says that the idea of uniform standards is a good one, but these standards should be created and imposed by the Florida judiciary or legislature. Stopping the recounts solves nothing, he writes. It soon becomes apparent that neither Kennedy nor O’Connor share Rehnquist’s ideas on the jurisdiction of the Florida court, and will not join him in that argument. Kennedy writes the bulk of the majority opinion; as predicted, his opinion focuses primarily on the equal-protection clause of the Constitution. The liberal justices and clerks find Kennedy’s reasoning that stopping the recounts is the only way to ensure equal protection entirely unconvincing. Anthony Scalia circulates a sealed memo complaining about the tone of some of the dissents, asking that the dissenters not call into question the Court’s credibility. (His memo prompts Ginsburg to remove a footnote from her dissent commenting on Florida’s disenfranchised African-American voters; some of the liberal clerks see the incident as Ginsburg being bullied into compliance by Scalia. Subsequent investigations show that thousands of legitimate African-Americans were indeed disenfranchised—see November 7, 2000.) Kennedy sends a memo accusing the dissenters of “trashing the Court,” and says that the dissenters actually agree with his equal-protection argument far more than they want to admit. When he has a line inserted into his opinion reading, “Eight Justices of the Court agree that there are constitutional problems with the recount ordered by the Florida Supreme Court that demand a remedy,” some of Stevens’s clerks angrily telephone Kennedy’s clerks and accuse them of misrepresenting Stevens’s position. They demand that the line be removed. Kennedy refuses, and Stevens rewrites his opinion so that he is no longer associated with the position. Kennedy is forced to rewrite the statement to say that “seven,” not “eight” justices agree with his position. One of Stevens’s clerks, Eduardo Penalver, tells Kennedy clerk Grant Dixton that what Kennedy had done was disgusting and unprofessional. Breyer and his clerks are also unhappy about Kennedy’s assertion, but take no action. The line prompts many in the media to claim, falsely, that the decision is a 7-2 split and not a 5-4. The main document, a short unsigned opinion halting the recounts, is written by Kennedy. Two portions are particularly notable: Kennedy’s assertion that the ruling applies only to Bush, and not to future decisions; and that the Court had only reluctantly accepted the case. “That infuriated us,” one liberal clerk later recalls. “It was typical Kennedy bullsh_t, aggrandizing the power of the Court while ostensibly wringing his hands about it.” Rehnquist, Scalia, and Justice Clarence Thomas join the decision, though Scalia is unimpressed with Kennedy’s writing and reasoning. Reportedly, he later calls it a “piece of sh_t,” though he will deny making the characterization.
Lack of Consensus - The lack of consensus between the conservative justices is relatively minor. Among the four liberal justices, though, it is quite pronounced—though all four wish not to end the recounts, only Stevens has a strong position and has stayed with it throughout the process. Souter, Ginsburg, and Breyer were far less certain of their opposition, and resultingly, their dissents, unlike the impassioned Stevens dissent, are relatively pallid. Some of the liberal clerks say that the four’s lack of consensus helped the solid conservative majority stay solid: “They gave just enough cover to the five justices and their defenders in the press and academia so that it was impossible to rile up the American people about these five conservative ideologues stealing the election.”
Final Loss - Gore, reading the opinion, finally realizes that he and his campaign never had a chance with the five conservative justices, though they had hoped that either O’Connor or Kennedy would join the four liberals (see (November 29, 2000)). He congratulates his legal team, led by David Boies, and commends it for making it so difficult for the Court to justify its decision. Some reports will circulate that Souter is depressed over the decision, with Newsweek reporting that he later tells a group of Russian judges that the decision was “the most outrageous, indefensible thing” the Court had ever done. He also reportedly says that had he had “one more day,” he could have convinced Kennedy to turn. However, Souter will deny the reports, and those who know him will say that such comments would be out of character for him. For her part, O’Connor will express surprise that anyone could be angry over the decision. As for Scalia, some Court observers believe that his open partisanship during the process will cost him any chance he may have had to be named chief justice. [Vanity Fair, 10/2004]

Former President Clinton has left the White House, to spend the rest of his life “goosing waitresses [and] defending himself in court.” Hillary “has no future beyond the US Senate… [she is] maxed out.” But, he warns, “Clintonism may yet rise again.… On February 27th, Chelsea Clinton will turn 21.”
'I Hate Chelsea Clinton' - Derbyshire confesses: “I hate Chelsea Clinton. I admit it’s not easy to justify my loathing of this person. I can pick out causes, but none of them is one hundred per cent rational.… I admit, I hate Chelsea because she is a Clinton.” After noting the negative reactions to his previous attack on the younger Clinton’s physical appearance, he acknowledges that she hasn’t committed the “array of crimes” her father is allegedly responsible for, but “she doesn’t deserve any credit for not having done these things; she just hasn’t had time yet.” He writes that since she was 18, she has “sign[ed] on to the Great Clinton Project. Which is, has always been, and forever will be, to enrich the family from the public fisc, and to lie, bomb, bribe, and intimidate your way out of trouble when necessary.”
'Sippenhaft' - Derbyshire notes that in totalitarian societies of the past, many people were executed merely because of their family connections, and says the same should be considered for Chelsea Clinton. “Chelsea is a Clinton,” he writes. “She bears the taint; and though not prosecutable in law, in custom and nature the taint cannot be ignored. All the great despotisms of the past—I’m not arguing for despotism as a principle, but they sure knew how to deal with potential trouble—recognized that the families of objectionable citizens were a continuing threat. In Stalin’s penal code it was a crime to be the wife or child of an ‘enemy of the people.’ The Nazis used the same principle, which they called Sippenhaft, ‘clan liability.’ In Imperial China, enemies of the state were punished ‘to the ninth degree’: that is, everyone in the offender’s own generation would be killed, and everyone related via four generations up, to the great-great-grandparents, and four generations down, to the great-great-grandchildren, would also be killed.… We don’t, of course, institutionalize such principles in our society, and a good thing too. Our humanity and forbearance, however, has a cost. The cost is that the vile genetic inheritance of Bill and Hillary Clinton may live on to plague us in the future. 'Hysterical Idiots' - After a week of angry criticism, Derbyshire will write a column defending his original column as “satire,” blaming “liberals” for “missing the joke,” and admitting his column “wasn’t meant to be a thigh-slapper. I had a point to make: There could be another Clinton in our future, and on present evidence (admittedly rather scant), it would be a chip off the old block. That’s fair comment. However, my tone was partly tongue in cheek.… Humor and irony are especially tricky.” He asks, rhetorically, if he intends to apologize, and answers himself: “In your dreams. I make it a point of principle never to apologize to hysterical idiots.” [National Review, 2/22/2001]

National Public Radio airs a profile of the documentary, featuring an interview with the film’s producers, Marc Levin, Daphne Pinkerson, and Daniel Voll. According to Voll, the film focuses on three members of the “Army of God”: young recruit Jonathan O’Toole, who says he was looking for the most “radical” and “terroristic” anti-abortion group he could find; Neal Horsley, who runs an anti-abortion Web site; and long-haul trucker Bob Lokey, who recruits new members.
'Violent Fringe' of Anti-Abortion Opposition - Voll describes the three as part of the “violent fringe” of anti-abortion opposition: “These are the guys on the ground who are—whatever the words that politicians and other leaders of these cultural wars can put out there, these are the men who hear them and feel emboldened by them, who feel encouraged by each other, and they are every day praying for God’s will in their life.” Another unidentified man says: “Anybody who raises a weapon up against these people who are slaughtering these babies, before God and the entire world, right now I say you are doing God’s own work. And may the power of God be with you as you aim that rifle. You’re squeezing that trigger for Almighty God.” In the documentary, an unidentified anti-abortion activist says: “There are people in this world right now who are looking for directions on what do we do. Well, we end abortion on demand by the most direct means available to us. So stop the abortion with a bullet, if that’s what it takes. Stop it with a bomb, if that’ s what it takes. You stop abortion on demand. Don’t let it go any farther.” O’Toole says that the “next step is to arm ourselves in a militia, a real militia that has the power to resist the federal government.” Pinkerson says that O’Toole, who was 19 when he joined the Army of God, found Horsley on the Internet through Horsley’s Web site, “The Nuremberg Files,” which lists doctors who perform abortions (see January 1997). O’Toole became Horsley’s assistant, and through him met Lokey, who runs a Web site called “Save the Babies.” In the film, O’Toole, whom the producers speculate may eventually become an assassin of abortion providers, says that because of America’s legalization of abortion, the country has become like “Nazi Germany. It’s like you’ve got concentration camps around you.” Levin notes that filmed conversations between Horsley and Lokey show that many in the movement feel threatened by the concept of women’s equality, and blame men’s failure to exert “dominion” over women as part of the reason why the US legalized abortion. Opposition to Homosexuality - Horsley draws a connection between the organization’s opposition to abortion and the American citizenry’s supposed opposition to homosexuality, saying: “If the American people woke up, and realized that they had to choose between legalized abortion, legalized homosexuality, and legalized all the rest of the desecration or civil war which would cause the rivers to run red with blood—hey, you know we will see legalized abortion go like that! We’ll see legalized homosexuality go like that! Because the American people are not willing to die for homosexuals.”
Bringing Bomb-Making Materials to Washington - The film also shows Lokey bragging to convicted clinic bomber Michael Bray (see September 1994) that he has just trucked 45,000 pounds of ammonium nitrate, a substance that can be used to make “fertilizer bombs” similar to the one that destroyed an Oklahoma City federal building (see 8:35 a.m. - 9:02 a.m. April 19, 1995), into Washington, DC.
Anti-Abortion Opposition Part of an 'Apocalyptic' Death Struggle - Author and reporter Frederick Clarkson writes: “At once shocking, compelling, and beautifully made, the film is essentially the national television debut for the aboveground spokesmen and spokeswomen of the Army of God.… Horsley and others are quite clear in their public statements and their writings that the attacks on clinics and the murders of doctors are but warning shots in what they envision as an epochal, even an apocalyptic struggle at hand. Either Americans conform to their view of God’s laws, or there will be a blood bath, they say. And there is no evidence that they are anything but dead serious.” [Womens eNews, 3/30/2001]

[Source: Washington Policy Group]Conservative columnist George Will calls two anti-war House Democrats “American collaborators” working with Saddam Hussein, either implicitly or directly. Will singles out Representatives Jim McDermott (D-WA) and David Bonior (D-MI) for criticism because of their opposition to the impending Iraq invasion. Will compares the two to World War II propaganda maven William Joyce, the British citizen who earned the sobriquet “Lord Haw Haw” for his pro-Nazi diatribes on the radio, and goes on to observe that McDermott and Bonior provided a spectacle unseen by Americans “since Jane Fonda posed for photographers at a Hanoi anti-aircraft gun” during the Vietnam War. McDermott and Bonior became a target for Will’s wrath by saying they doubted the Bush administration’s veracity in its assertions that Iraq has large stashes of WMD, but believed Iraqi officials’ promises to allow UN inspectors free rein to look for such weapons caches. “I think you have to take the Iraqis on their value—at face value,” McDermott told reporters in recent days, but went on to say, “I think the president [Bush] would mislead the American people.”
Leninist 'Useful Idiots' - After comparing the two to Joyce and Fonda, Will extends his comparison to Bolshevik Russia, writing: “McDermott and Bonior are two specimens of what Lenin, referring to Westerners who denied the existence of Lenin’s police-state terror, called ‘useful idiots.’” Will also adds UN Secretary-General Kofi Annan in this last category, compares Annan with British “appeaser” Neville Chamberlain for good measure, and labels him “Saddam’s servant.”
Slamming Democrats for Not Supporting War - Will saves the bulk of his ire for the accusations by McDermott and Bonior that Bush officials might be lying or misrepresenting the threat of Iraqi WMD, and adds former Vice President Al Gore to the mix. “McDermott’s accusation that the president—presumably with Cheney, Powell, Rumsfeld, Rice, and others as accomplices—would use deceit to satisfy his craving to send young Americans into an unnecessary war is a slander licensed six days earlier by Al Gore,” Will writes. Extending his comparisons to the Watergate era, Will adds, “With transparent Nixonian trickiness—being transparent, it tricks no one—Gore all but said the president is orchestrating war policy for political gain in November.” Will accuses Gore and other Democrats of what he calls “moral infantilism” because they voted to support the 1998 Iraq Liberation Act (see October 31, 1998). Will returns to his complaints about the Democratic congressmen in his conclusion: “McDermott’s and Bonior’s espousal of Saddam’s line, and of Gore’s subtext (and Barbra Streisand’s libretto), signals the recrudescence of the dogmatic distrust of US power that virtually disqualified the Democratic Party from presidential politics for a generation. It gives the benefits of all doubts to America’s enemies and reduces policy debates to accusations about the motives of Americans who would project US power in the world. Conservative isolationism—America is too good for the world—is long dead. Liberal isolationism—the world is too good for America—is flourishing.” [Washington Post, 10/1/2002]

[Source: Slate]The Wall Street Journal’s editorial page editor emeritus, Robert Bartley, acknowledges that Fox News’s slogan, “We report, you decide,” is a “pretense.” Bartley, a staunch conservative, writes: “Even more importantly, the amazing success of Roger Ailes at Fox News (see October 7, 1996) has provided a meaningful alternative to the Left-establishment slant of the major networks.… His news is no more tilted to the right than theirs has been on the left, and there’s no reason for him to drop his ‘we report, you decide’ pretense until they drop theirs” (see October 13, 2009). [Jamieson and Cappella, 2008, pp. 49] In May 2003, ABC News president David Westin will say: “I like ‘We report. You decide.’ It’s a wonderful slogan. Too often, I don’t think that’s what’s going on at Fox. Too often, they step over the line and try and help people decide what is right and wrong.” Fox News pundit and host Bill O’Reilly will agree. Asked whether a more accurate tag line for Fox might be “We report. You decide.’ It’s a joke. Florida’s Second Court of Appeals overturns a wrongful-firing ruling against Fox Television by a lower court (see August 18, 2000), finding in favor of the network against two citizen plaintiffs who claim they were fired by Fox News for refusing to falsify a news segment they were producing for a local affiliate. In essence, the court rules that Fox, and by extension other media outlets, can legally lie to their consumers: that there is no law against distorting or falsifying the news in the US. The appeals court holds that the plaintiffs’ threat to report the network to the Federal Communications Commission (FCC) does not deserve protection under Florida’s whistleblower statute, because a whistleblower must report “an employer breaking an adopted law, rule, or regulation.” The FCC has a policy against falsification of the news, but the court, in what the St. Louis Journalism Review will call “a stunningly narrow interpretation of FCC rules,” rules that the policy does not rise to the level of a “law, rule, or regulation.” Therefore, Fox Television’s Fox News Channel or any other news producer can produce willfully false stories and claim they are true, without fear of reprisal. In their court arguments, lawyers for Fox Television asserted that no rules or laws exist that prohibit distorting or falsifying news reports: that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on the public airwaves. The attorneys did not dispute that network officials pressured the plaintiffs to produce a false story; instead, they argued that it was the network’s right to do so. Fox Television won “friend of the court” support from five major news owners: Belo Corporation, Cox Television, Gannett, Media General Operations, and Post-Newsweek Stations. The New Yorker reports the results of an Annenberg survey of 673 mainstream news owners, executives, editors, producers, and reporters. Among the survey’s findings is the strong belief that Fox News (see 1995, October 7, 1996, and October 13, 2009)) has had a strong influence on the way broadcasters cover the news, as well as how others present the news on network and cable television programs. In 2002, when the CEO of General Electric, Jeffrey Immelt, was asked how he wanted to improve his own cable news network, MSNBC, he said: “I think the standard right now is Fox. Conservative talk show host Rush Limbaugh announces the results of a poll finding: “We have a great Gallup poll, folks. Sixty percent of conservatives, 40 percent of moderates, and 18 percent of liberals say the media is too liberal.” Authors Kathleen Hall Jamieson and Joseph N. Cappella later write that Limbaugh “creates an interpretative frame for the information,” with Limbaugh saying, “We all know that moderates are liberals anyway, so that would be 58 percent of liberals and 60 percent of conservatives, that’s over 100 percent of the people who think the media is too liberal.” Neither Jamieson nor Cappella point out the creative mathematics and regrouping Limbaugh is performing. They do note, however, that on Fox News, commentator Tony Snow reports the same poll results, and accuses the “liberal media” of failing to report the poll in a widespread fashion. When CBS and CNN would lead a news item about an impending execution with a candlelight vigil of death-penalty protesters, for example,” Anderson quotes Fox senior vice president for news John Moody as saying it is “de riguer that we put in the lead why the person is being executed.” Anderson continues, “Fox viewers will see Republican politicians and conservative pundits sought out for meaningful quotations, skepticism voiced about environmental ‘doomsaying,’ religion treated with respect, pro-life views given airtime—and much else they’d never find on other networks” (see October 13, 2009). [Source: Business Insider]Roger Ailes, a powerful Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988) and the founder and chairman of Fox News (see October 7, 1996), becomes embroiled in a legal conflict involving former New York Police Commissioner Bernard Kerik and his mistress, Judith Regan, a book editor for another arm of Fox News’s parent company News Corporation (NewsCorp). Ailes learns that Kerik has commandeered an apartment overlooking the site of the devastated World Trade Center, intended for the use of rescue and recovery workers, as a “love nest” for his trysts with Regan. Ailes is a close friend and political ally of former New York Mayor Rudolph Giuliani, who recommended Kerik to head the Department of Homeland Security. Kerik is already being pilloried in the press for a number of other ethical and perhaps even criminal activities, and is being vetted for the DHS slot. Ailes and Giuliani do not want the Kerik-Regan affair, and the commandeered apartment, to come to the public’s notice. Court documents later say that Ailes “told Regan that he believed she had information about Kerik that, if disclosed, would harm Giuliani’s presidential campaign.” Ailes “advised Regan to lie to, and to withhold information from, [federal] investigators concerning Kerik.” The attempted cover-up will later be brought to light when NewsCorp fires Regan in 2006, and she brings a wrongful-termination suit that secures a $10.75 million settlement. Regan will not identify Ailes by name, only as a “senior executive” for NewsCorp, but other documents accidentally made public will reveal Ailes’s identity. Reportedly, Regan has her telephone conversations with Ailes on tape. NewsCorp will later claim that Regan has sent it a letter stating that “Mr. Ailes did not intend to influence her with respect to a government investigation.” Regan’s lawyer will say that NewsCorp’s claim does not reflect the entirety of Regan’s letter. Kerik himself will withdraw his name from consideration, and will later be sentenced to four years in prison for tax fraud. CNN announces that conservative pundit Dinesh D’Souza is a new political analyst for the network. D’Souza became active in conservative politics and punditry as an editor of the Dartmouth Review in the early 1980s, where he authored and published numerous inflammatory articles reviling, among others, blacks, Jews, and gays (see 1981, March 15, 1982, October 1982, and 1983). From Dartmouth, D’Souza went to the White House, where he served as a senior domestic policy analyst in the Reagan administration. He has served as a fellow at the American Enterprise Institute and the Hoover Institution, and published a number of books, including 1995’s inflammatory The End of Racism, which progressive media watchdog organization Media Matters described as advancing the idea that “low-income black people are basically ‘pathological’ and that white racism really isn’t racism at all, just a logical response to this ‘pathology.’” D’Souza’s Web site “argues that the American obsession with race is fueled by a civil rights establishment that has a vested interest in perpetuating black dependency”; in a 1995 Wall Street Journal op-ed, he argued that “[t]he best way for African-Americans to save private sector affirmative action may be to repeal the Civil Rights Act of 1964.” Two African-American conservatives, Glenn Loury and Robert Woodson, resigned from AEI after the publication of The End of Racism and another racially objectionable book, The Bell Curve, by AEI fellow Charles Murray. A Pew Center for the People and the Press study finds that 35 percent of Republicans consistently watch Fox News, while 21 percent of Democrats do so. Fox has experienced the largest increase in viewers, and 52 percent of its audience defines itself as conservative. In general, Republicans consider Fox the most reliable broadcast news outlet, while Democrats consider it the least reliable. Overall, trust in mainstream news outlets, from CNN and ABC to the Wall Street Journal and the New York Times, has declined sharply since 2000. The Federal Election Commission (FEC) dismisses the complaint “Citizens United v. Michael Moore and Fahrenheit 9/11.” The conservative lobbying group Citizens United (CU—see (May 11, 2004)) had complained to the Federal Election Commission (FEC) that liberal documentarian Michael Moore released a movie, Fahrenheit 9/11 (see June 25, 2004), that was so critical of the Bush administration that it should be considered political advertising. If the movie is indeed political advertising, under federal law it cannot be shown within 30 days before a primary election or 60 days before a general election. The FEC dismisses the complaint, finding no evidence that the movie’s advertisements had broken the law. The movie’s distributors, Lions Gate, assure the FEC that they do not intend to advertise the movie during the time periods given under the law. [Federal Election Commission, 8/6/2004; Moneyocracy, 2/2012] In the aftermath of the FEC decision, CU leaders Floyd Brown (see September 21 - October 4, 1988) and David Bossie will decide that they can do what Moore did, and decide to make their own “documentaries.” Bossie realized after Fahrenheit 9/11 aired that it, and the television commercials promoting it, served two purposes—attacking President Bush and generating profits. Having already conducted an examination of the career of former First Lady Hillary Clinton (D-NY), now a sitting senator with presidential aspirations, the organization will decide to make its first “feature film” about her (see January 10-16, 2008). Fox News talk show host Sean Hannity claims, falsely, that former vice president and Democratic presidential candidate Al Gore “brought Willie Horton to the American people.” Hannity is referring to the infamous “Willie Horton” ad of the 1988 presidential campaign, a Republican campaign strategy that claimed African-American Willie Horton was released and went on to rape a white woman by Democratic presidential candidate Michael Dukakis (see September 21 - October 4, 1988). Hannity’s statement comes in response to a recent citation of the Horton ad by Princeton University professor Cornel West, who cited the ad as an example of the Republican Party’s political exploitation of race. Hannity notes correctly that in the 1988 Democratic presidential primaries, Gore asked Dukakis about “weekend passes for convicted criminals,” referring to the Massachusetts furlough program that freed Horton. However, Gore never mentioned Horton at all. The first national mention of Horton came in the ads released by the Bush campaign and by an ostensibly independent conservative organization, the National Security Political Action Committee (NSPAC). According to progressive media watchdog organization Media Matters, Hannity has made similar claims about Gore first bringing up Horton in the past. [Media Matters, 11/10/2004]

US News and World Report senior writer Michael Barone accuses Democratic pollster Anna Greenberg of “blood libel on the American people” in response to Greenberg’s claim that the 1988 Bush campaign ads featuring convicted murderer Willie Horton were examples of “racial politics” (see September 21 - October 4, 1988). The progressive media watchdog organization Media Matters will note that the phrase “blood libel” specifically denotes accusations that a particular group, often Jews, practices human sacrifice, and cites one famous (and entirely false) allegation that “Jews kill Christian and Muslim children and use their blood to make Passover matzohs.” Barone and Greenberg are panelists on the evening’s edition of The Kalb Report, a panel discussion on C-SPAN hosted by journalist and author Marvin Kalb. The topic of the current discussion is “A Post-Election Analysis: Values, Religion, Politics, and the Media.” Greenberg calls the Horton ads examples of “racial politics in the 1980s,” to which Barone says in response: “I think this whole Willie Horton thing is a slur on the American people. The argument has been made by Democrats and liberals that the Bush campaign in ‘88 supposedly showed pictures of this man. It did not. There was an independent expenditure ad that did. But they did not. They showed white prisoners in the ad. And the argument against [1988 Democratic presidential candidate] Michael Dukakis, which he never effectively countered because there is no effective counter, is that giving furlough to people who have life without parole is a position that Dukakis defended over 11 years as governor of Massachusetts or governor candidate, is a crazy law, and he supported it over 11 years. You don’t have to be a racist to want a murderer, whatever his race, to stay in jail and not be allowed outside on the weekend. To say that the American people were racist and they just want black people in, is blood libel on the American people.” Barone is incorrect in saying that Horton’s picture was never used in the ads (it was not used in official Bush campaign ads, but it was used in ads by purportedly “independent” organizations supporting the Bush candidacy), and he fails to note that while Dukakis indeed supported the Massachusetts furlough law that allowed Horton the freedom to commit felonies even after being sent to jail for murder, he did not enact the law. Media Matters will note that the Horton ads have long been accepted as strong examples of racial politics, including a 1995 statement from Secretary of State Colin Powell who called the ads “racist.” [Media Matters, 11/17/2004]

Oil billionaire David Koch and Koch Industries lobbyist Richard Fink (see August 30, 2010) launch a new “astroturf” organization, Americans for Prosperity (AFP—see May 29, 2009)). They hire Tim Phillips to run the organization. Phillips (see August 6, 2009) is a veteran political operative who worked closely with Republican operative Ralph Reed; the two co-founded the political consulting firm Century Strategies. Phillips’s online biography will describe him as an expert in “grasstops” and “grassroots” political organizing. Conservative operative Grover Norquist will call Phillips “a grownup who can make things happen.” In 2009, Phillips will claim that AFP has “only” 800,000 members, but its Web site will claim “1.2 million activists.” A former employee of the Cato Institute, a Koch-founded libertarian think tank, will say that AFP is “micromanaged by the Kochs” (indicating involvement by both David and Charles Koch). Fox News senior anchor Brit Hume and Fox analyst William Bennett both make the false claim that former President Franklin D. Roosevelt wanted to replace Social Security with private accounts. In fact, Roosevelt, who implemented Social Security, was in favor of “voluntary contributory annunities” to supplement Social Security benefits, but never proposed replacing Social Security with private money. Hume and Bennett both support President Bush’s plan to partially “privatize” Social Security; Bush himself has asserted, equally falsely, that Roosevelt supported privatization. On Fox’s political talk show Hannity and Colmes, Bennett tells viewers: “Franklin Delano Roosevelt, the guy who established Social Security, said that it would be good to have it replaced by private investment over time. Private investment would be the way to really carry this thing through.” That same evening, Hume tells his audience: “In a written statement to Congress in 1935, Roosevelt said that any Social Security plans should include, quote, ‘Voluntary contributory annuities, by which individual initiative can increase the annual amounts received in old age,’ adding that government funding, quote, ‘ought to ultimately be supplanted by self-supporting annuity plans.’” Hume fails to point out that Roosevelt was not talking about “supplant[ing]” Social Security with any “self-supporting annuity plans,” but instead was talking about a different fund that provided pension benefits to Americans too old (in 1935) to contribute payroll taxes to Social Security. In 1935, Edwin Witte, the director of the Committee on Economic Security, told Congress flatly that voluntary accounts were intended as a “separate undertaking” meant to “supplement” the compulsory system, not replace it. [Media Matters, 2/4/2005] Days before the Fox broadcasts, Roosevelt’s grandson James Roosevelt Jr., a former Social Security associate commissioner, noted that “Bush invoked the name of my grandfather… as part of his campaign to privatize Social Security,” and added, “The implication that FDR would support privatization of America’s greatest national program is an attempt to deceive the American people and an outrage.” [Boston Globe, 1/31/2005] Liberal pundit Al Franken calls on Hume to resign over his historical distortions; MSNBC host Keith Olbermann calls Hume’s statements “premeditated, historical fraud,” and Roosevelt Jr. says that “outrageous distortion… calls for a retraction, an apology, maybe even a resignation.” [Media Matters, 2/18/2005] Influential conservative blogger Glenn Reynolds will acknowledge that Roosevelt was not advocating for the privatization of Social Security, instead noting that Roosevelt’s plan “would have involved, essentially, a sort of government-supplied 401k plan.” [Glenn Reynolds, 2/4/2005]

Fox News talk show host Sean Hannity and conservative radio host Laura Ingraham repeat the long-debunked claim that former vice president and Democratic presidential candidate Al Gore first mentioned convicted murderer and rapist Willie Horton in the context of a political campaign. Hannity and Ingraham are referring to the infamous “Willie Horton” ad of the 1988 presidential campaign, a Republican campaign strategy that falsely claimed African-American Willie Horton was released and went on to rape a white woman by Democratic presidential candidate Michael Dukakis (see September 21 - October 4, 1988). [Source: Ashbrook Center, Ashland University]William Bennett, the conservative radio host, Fox News contributor, and former secretary of education under Ronald Reagan, tells his listeners that one way to drop the US crime rate would be to “abort every black baby in this country.” Bennett, who reaches a weekly audience of some 1.25 million, is apparently going off a claim in the economic treatise Freakonomics by Steven Levitt and Stephen Dubner, who argued that legalized abortion has lowered crime rates, since many aborted fetuses, growing up in poor homes and in single-parent or teenaged-parent homes, would have been more likely to commit crimes. Levitt and Dubner made no race-based claims. A caller to Bennett’s show says the national media “talk[s] a lot about the loss of revenue, or the inability of the government to fund Social Security, and I was curious, and I’ve read articles in recent months here, that the abortions that have happened since Roe v. Wade (see January 22, 1973), the lost revenue from the people who have been aborted in the last 30-something years, could fund Social Security as we know it today. And the media just doesn’t—never touches this at all.” After some back-and-forth about assumptions over how many of those aborted fetuses would have grown up to be productive citizens, speculations about costs, and Bennett’s citation of the Freakonomics claim, he says: “I do know that it’s true that if you wanted to reduce crime, you could—if that were your sole purpose, you could abort every black baby in this country, and your crime rate would go down. That would be an impossible, ridiculous, and morally reprehensible thing to do, but your crime rate would go down. So these far-out, these far-reaching, extensive extrapolations are, I think, tricky.” [Media Matters, 9/28/2005; CNN, 9/30/2005] Bennett will face heavy criticism for his remarks (see September 29-30, 2005), but in his turn will claim that he is the one owed the apology (see September 30 - October 1, 2005).

The authors of a new media study say that they were “surprised” to find how much of a “liberal bias” exists in the American press. The study will later be found to be fundamentally flawed in its methodology and its conclusions (see December 2004). Even the Wall Street Journal and the right-wing Internet media and gossip outlet the Drudge Report are liberally biased, authors Tim Groseclose and Jeffrey Milyo find. The most centrist media outlet of the ones studied is, the authors claim, PBS’s NewsHour with Jim Lehrer. The news report on the study, by the UCLA Newsroom, claims the report is “the first successful attempt at objectively quantifying bias in a range of media outlets and ranking them accordingly.” Groseclose says: “I suspected that many media outlets would tilt to the left because surveys have shown that reporters tend to vote more Democrat than Republican. But I was surprised at just how pronounced the distinctions are.” Milyo adds, “Overall, the major media outlets are quite moderate compared to members of Congress, but even so, there is a quantifiable and significant bias in that nearly all of them lean to the left.” The news report explains that the authors “based their research on a standard gauge of a lawmaker’s support for liberal causes. Americans for Democratic Action (ADA) tracks the percentage of times that each lawmaker votes on the liberal side of an issue. Based on these votes, the ADA assigns a numerical score to each lawmaker, where ‘100’ is the most liberal and ‘0’ is the most conservative. After adjustments to compensate for disproportionate representation that the Senate gives to low-population states and the lack of representation for the District of Columbia, the average ADA score in Congress (50.1) was assumed to represent the political position of the average US voter. Groseclose and Milyo then directed 21 research assistants—most of them college students—to scour US media coverage of the past 10 years. They tallied the number of times each media outlet referred to think tanks and policy groups, such as the left-leaning NAACP or the right-leaning Heritage Foundation. Next, they did the same exercise with speeches of US lawmakers. If a media outlet displayed a citation pattern similar to that of a lawmaker, then Groseclose and Milyo’s method assigned both a similar ADA score.” “A media person would have never done this study,” Groseclose says. “It takes a Congress scholar even to think of using ADA scores as a measure. And I don’t think many media scholars would have considered comparing news stories to Congressional speeches.” According to the study, the “leftward tilt” of news broadcasts by ABC and CBS is “nearly perfectly balanced” by the slight rightward tilt of Fox News. “Past researchers have been able to say whether an outlet is conservative or liberal, but no one has ever compared media outlets to lawmakers,” Groseclose says. “Our work gives a precise characterization of the bias and relates it to known commodity—politicians.” [UCLA Newsroom, 12/14/2005]

The media discovers a study from late 2004 purporting to show that the mainstream media in the US is heavily biased towards liberal views (see December 2004 and December 14, 2005). On December 19, MSNBC host Tucker Carlson, a conservative, interviews one of the study’s authors, Jeffrey Milyo of the University of Missouri-Columbia. Milyo repeats the study’s contention that news outlets such as CBS News, the Los Angeles Times, the New York Times, and the Wall Street Journal are heavily liberal in their coverage. Carlson calls the statement “terrifying.” Milyo repeats the assertion often made by conservatives that most reporters “tend to be about as liberal as the voters in Berkeley, California.… And the same is true in academia too, by the way, and you know, so that doesn’t mean that those preconceptions or biases or favoritism infects the job that people do.” [MSNBC, 12/19/2005] The study is also cited on the December 19 edition of Fox News’s morning show, Fox and Friends [Fox News, 12/19/2005; Media Matters, 12/21/2005] , and that evening on Fox’s Special Report with Brit Hume. It’s real, according to a new study led by the University of California at Los Angeles, which shows there is a strong liberal bias. Well, there’s a bulletin. Researchers found out that of 20 main media outlets, 18 scored to the left of center. The most liberal of all were the news pages of the Wall Street Journal, not the editorial pages, the news pages. Followed two, three, and four by the CBS Evening News, the New York Times, and the Los Angeles Times. In this study, only Special Report with Brit Hume over there on the F-word network [Fox News] and the Washington Times scored to the right of the average voter. The Wall Street Journal’s parent company, Dow Jones and Co., issues a statement that challenges the findings of a recent study claiming that the Journal is one of the most “liberally biased” news outlets in America (see December 2004 and December 14, 2005). Dow Jones states: “The Wall Street Journal’s news coverage is relentlessly neutral. Of that, we are confident. By contrast, the research technique used in this study hardly inspires confidence. In fact, it is logically suspect and simply baffling in some of its details. First, its measure of media bias consists entirely of counting the number of mentions of, or quotes from, various think tanks that the researchers determine to be ‘liberal’ or ‘conservative.’ By this logic, a mention of al-Qaeda in a story suggests the newspaper endorses its views, which is obviously not the case. And if a think tank is explicitly labeled ‘liberal’ or ‘conservative’ within a story to provide context to readers, that example doesn’t count at all. The researchers simply threw out such mentions.” The statement criticizes the study’s failure to “characterize” a number of “important policy groups” such as, “say, the Chamber of Commerce, the National Association of Manufacturers, the AFL-CIO, or the Concord Coalition, but that does include People for the Ethical Treatment of Animals?” It goes on to call the study’s attempt to rank the various groups “simply bizarre.” The statement concludes, “Suffice it to say that ‘research’ of this variety would be unlikely to warrant a mention at all in any Wall Street Journal story.” [Poynter Online, 12/21/2005]

The Wall Street Journal’s Stephen Moore interviews reclusive billionaire Charles Koch, the head of the Koch Brothers oil empire. Among the items of interest in the interview is Koch’s admission that he, along with his brother David (see 1977-Present, 1979-1980, 1981-2010, 1984 and After, and Late 2004), coordinates the funding of the conservative infrastructure of some of the most influential front groups, political campaigns, think tanks, media outlets, and other such efforts through a semiannual meeting with wealthy conservative donors. (Moore himself receives Koch funding for his work, according to a Think Progress report published four years later. In return, Moore is quite laudatory in the interview, writing that Koch is a “creative forward-thinking… professorial CEO” who “is immersed in the ideas of liberty and free markets.”) Koch tells Moore that his basic goal is to strengthen what he calls the “culture of prosperity” by eliminating “90 percent” of all laws and government regulations. Moore writes of the twice-yearly conference: “Mr. Koch’s latest crusade to spread the ideas of liberty has been his sponsorship of a twice-yearly conference that gathers together many of the most successful American entrepreneurs, from T. Boone Pickens to former Circuit City CEO Rick Sharp. The objective is to encourage these captains of industry to help fund free-market groups devoted to protecting the fragile infrastructure of liberty. That task seems especially critical given that so many of the global superrich, like George Soros and Warren Buffett, finance institutions that undermine the very system of capitalism that made their success possible (see January - November 2004). Progressive media watchdog Web site Media Matters notes that the book relies on long-discredited accusations from the authors’ “Front Page Magazine” Web site, from their articles on conservative Web publications such as WorldNetDaily and NewsMax, and on unsourced allegations from political extremist Lyndon LaRouche and his followers, who have called Soros a “Nazi beast-man” and a “small cog in Adolf Eichmann’s killing machine,” aiding “the Holocaust against 500,000 Hungarian Jews.” Media Matters calls the book “a new low in the long-running Republican Party and conservative movement campaign of scurrilous personal attacks against Soros, a major supporter of progressive causes in the US and abroad.” The organization also notes that the Web sites used in the book’s research are largely funded by conservative billionaire Richard Mellon Scaife, and Scaife-owned newspapers such as the Pittsburgh Tribune-Review have promoted the book. Roger Ailes, the founder and chairman of Fox News (see October 7, 1996), makes a joke to an audience of news executives: “It is true that Barack Obama is on the move,” he says. “I don’t know if it’s true that President Bush called [Pakistani President Pervez] Musharraf and said, ‘Why can’t we catch this guy?’” The joke is a deliberate conflation between the names of presidential candidate Barack Obama (D-IL) and Osama bin Laden. Ailes has Steve Doocy and the other hosts of his network’s morning news show Fox and Friends begin making similar jokes. Fox insiders will later note that while the banter between Doocy, Brian Kilmeade, and Gretchen Carlson appears to be mostly ad-libbed, it is actually highly structured; Ailes uses the show as one of the primary vehicles to get his daily message into what reporter Tim Dickinson will call “the media bloodstream.” Ailes meets with Doocy, Kilmeade, and Carlson every day before the 6:00 a.m. start; a former Fox News deputy will later say: “Prior to broadcast, Steve Doocy, Gretchen Carlson—that gang—they meet with Roger. And Roger gives them the spin.” Doocy is the first Fox News figure to publicly state that Obama attended a radical Islamist madrassa as a child, a falsification that begins circulating on the Internet around this same time (see October 1, 2007). Martin Peretz, the editor in chief of The New Republic, falsely accuses Jewish billionaire George Soros of being a Nazi collaborator. Soros is now a target of conservative opprobrium for his financial support of Democratic and progressive causes. As a 14-year-old boy, Soros escaped from the Nazis by hiding with a non-Jewish family in Hungary; the father of that family sometimes served deportation notices to Hungarian Jews. Peretz now calls Soros “a young cog in the Hitlerite wheel.” The progressive media watchdog Web site Media Matters notes that Peretz is following the lead of right-wing extremists David Horowitz and Richard Poe, whose book The Shadow Party: How George Soros, Hillary Clinton, and Sixties Radicals Seized Control of the Democratic Party claimed that Soros “survived [the Holocaust] by assimilating to Nazism.” The book was found to be riddled with doctored quotes and factual errors (see August 8, 2006). Peretz uses a transcript of a 1998 interview Soros gave to 60 Minutes reporter Steve Kroft to prove his claim, but edits the transcript to leave out a key section that shows Soros did not collaborate with Nazis. Representative Ron Paul, profiled in a New York Times article, answers a question about his connections to the John Birch Society (JBS—see March 10, 1961, 1978-1996, August 4, 2008 and December 2011). “Oh, my goodness, the John Birch Society!” Paul replies in what the reporter calls “mock horror.” “Is that bad? I have a lot of friends in the John Birch Society. They’re generally well educated and they understand the Constitution. I don’t know how many positions they would have that I don’t agree with. Because they’re real strict constitutionalists, they don’t like the war, they’re hard-money people.” [New York Times, 7/22/2007] The JBS is, according to the Southern Poverty Law Center, a prominent right-wing extremist group that has accused a number of lawmakers, including former President Dwight D. Eisenhower, of being “closet Communists,” and promotes “wild conspiracy theories” such as the “international Jewish” conspiracy to control the global economy and the idea that the World War II Holocaust never happened. The JBS has been a pioneer in what an analysis by Political Research Associates (PRA) will call “the encoding of implicit cultural forms of ethnocentric white racism and Christian nationalist antisemitism rather than relying on the white supremacist biological determinism and open loathing of Jews that had typified the old right prior to WWII.” PRA will note, “Throughout its existence, however, the Society has promoted open homophobia and sexism.” [Political Research Associates, 2010; Southern Poverty Law Center, 8/17/2010]

An editorial in the conservative Investors Business Daily (IBD) claims that presidential candidate Barack Obama (D-IL) is an “African nativist” driven by anti-American and anti-Christian views. According to the IBD editorial, “disturbing information has come to light” showing that “[a]t the core of the Democratic front-runner’s faith—whether lapsed Muslim, new Christian, or some mixture of the two—is African nativism, which raises political issues of its own.” The IBD editorial speculates that Obama is driven by “black nationalism” and fears that he and other African-Americans will continue to be held “captive” to “white culture” unless they take action. The editorial points to the Reverend Jeremiah Wright, one of the pastors of Chicago’s Trinity United Church of Christ where Obama and his family are members, as an “Afro-centric militant” who serves as Obama’s “personal spiritual adviser.” IBD then sounds the alarm about Obama’s “close family ties to Kenya,” particularly the “Muslim militants” of the Kenyan Luo tribe; Obama’s father was a Luo, as is his older half-brother Abongo “Roy” Obama, whom IBD describes as “a Luo activist… a militant Muslim,” and “a Marxist” who has “urge[d] his younger brother to embrace his African heritage.” IBD warns: “Beyond family politics, these ties have potential foreign policy, even national security, implications.… Would Obama put African tribal or family interests ahead of US interests? It’s a valid question, and one voters deserve to have debated regardless of the racial and religious sensitivities. Thanks to a media blackout of these issues, the electorate has yet to benefit from a thorough vetting of Obama.” IBD then informs its readers of Obama’s “Muslim past,” questioning his Christianity and worrying that if he is indeed a Christian, he would have repudiated his “childhood Muslim faith” and be viewed by Muslims as “an apostate,” thereby making him a possible target of “a fatwah” by radical Islamists. It concludes by avowing that Obama’s “Afrocentric doctrine” will be an overt threat to the US if he is elected president, stating, “If a President Obama’s foreign and domestic policies are anything like the Afrocentric doctrine he’s pledged to uphold, Americans will pay a hefty price, including those among the growing black middle class.” [Investor's Business Daily, 1/16/2008] The editorial comes three weeks after a similar claim by conservative scholar Daniel Pipes (see December 26, 2007), and days after conservative radio host Michael Savage claimed Obama was educated in an Islamic madrassa (see January 10, 2008). Reporters show that Senator Barack Obama (D-IL), a leading Democratic presidential candidate, was never educated in a “madrassa,” or Islamic school, as some of his political enemies claim. Insight Magazine, a subsidiary of the conservative Washington Times, recently reported that the presidential campaign of Senator Hillary Clinton (D-NY) had unearthed information showing that Obama was educated in an Indonesian madrassa during his childhood. The Clinton campaign disputes that it is the source of the story, and calls it “an obvious right-wing hit job.” Obama indeed lived in Indonesia from 1967 through 1971, with his mother and stepfather, but was not educated in a madrassa. Instead, Obama, who was six when his family moved to Indonesia, attended the Basuki School from 1969 through 1971. According to a school official: “This is a public school. We don’t focus on religion.” CNN correspondent John Vause, who visited the school, reports: “I came here to Barack Obama’s elementary school in Jakarta looking for what some are calling an Islamic madrassa… like the ones that teach hate and violence in Pakistan and Afghanistan.… I’ve been to those madrassas in Pakistan… this school is nothing like that.” A former classmate of Obama’s says the school was not radical in 1969: “It’s not [an] Islamic school. It’s general.… There is a lot of Christians, Buddhists, also Confucian.… So that’s a mixed school.” Associated Press reporters also visit two other schools attended by Obama, the SDN Menteng 1 and Fransiskus Assisi. SDN Menteng 1 is a secular public school, according to its vice principal, while Fransiskus Assisi is, according to the Indonesian Ministry of Religious Affairs, “clearly a Catholic school.” After the Insight story is repeated on Fox News, the Obama campaign calls those broadcasts “appallingly irresponsible.” [CNN, 1/22/2008; Associated Press, 1/24/2008] Despite the debunking, some conservative radio hosts continue to assert that Obama is a Muslim (see January 10, 2008, February 21, 2008, April 3, 2008, July 10, 2008, August 1, 2008 and After, August 21, 2008, and September 10, 2008).

As reported by progressive media watchdog site Media Matters, Caplis says the photo shows Obama wearing “the same type of turban and clothing that Osama bin Laden wears,” while Newman asks, “[W]hy do you think Obama really had the photo taken, dressed up as a Somali warlord?” The photo was taken during an August 2006 visit by Obama to Kenya, where his father was born. [Media Matters, 2/25/2008] It was published a few days ago by the conservative Drudge Report. According to Yusuf Garaad Omar, head of the BBC’s Somali Service, the robes are “the normal clothes that nomadic people wear. The head turban is especially used by elderly people as a suggestion of respect. It is something that has no meaning whatsoever in Somalia culture. If you see someone dressed like that in Somalia, you think it is a nomadic person—that is all. There is no religious significance to it whatsoever. It is mainly the nomadic people who use it. Some of them are religious, some are not. It is simply a tradition of the place where they are from. In this particular place, Wajir in north-east Kenya, the community is majority ethnic Somali.… This debate reminds me of people back home in Somalia, who say that women should not wear trousers, or other cultures who say men should not wear a tie. I just don’t think it makes sense.” [BBC, 2/26/2008] Caplis asks his listeners why Obama would “put on similar clothing to the outfit worn by the man who personally ordered thousands of Americans, including women and kids, to be burned to death,” and says that “it would be as if [former President] John Kennedy had gone out and thrown on the fatigues and the funny baseball hat that Castro wore.” Newman, like Caplis a nationally syndicated Clear Channel talk show host, tells his audience, according to Media Matters: “We were five years into the war on terror when Obama knowingly and willingly dressed up in Somali warlord garb to have his photo taken.” He asks if Obama wore the robes “to garner support from Muslim-Americans who ideologically support Muslim terrorists?” and then asks, “Would it have been right for [former President] Harry Truman to dress up like a Nazi in 1948?” Caplis also tells his audience, “[Obama’s] middle name is Hussein, which should not be held against him for a second; his last name rhymes with Osama, which should not be held against him for a second.” [Media Matters, 2/25/2008] Months later, Newman will tell his listeners that an Obama presidency will welcome “an invasion of Muslim terrorists” (see July 10, 2008).

As reported by progressive media watchdog site Media Matters, conservative radio host Michael Savage says of Democratic presidential candidate Barack Obama, “I think he was hand-picked by some very powerful forces both within and outside the United State of America to drag this country into a hell that it has not seen since the Civil War of the middle of the 19th century.” Savage is referring to controversial statements made by Obama’s former pastor, the Reverend Jeremiah Wright, whom Savage calls “the soul of Barack Obama’s movement.” Savage goes on to claim that Wright, and by extension Obama, align themselves with historical enemies of the United States: “And if you want a man who says not ‘God bless America,’ but ‘God d_mn America,’ if you want a man who takes the side of the imperial Japanese army, an army that killed not only hundreds of thousands in the Bataan Death March, but hundreds of thousand of Koreans, an army that operated on people while they were alive in Manchuria, a man who takes the side, in essence, of the Japanese Nazis of World War II, if you want a man who takes the side, in essence, of the Hitlers of the world, then you’ve got it in Barack Obama’s pastor, Jeremiah Wright, of the Trinity United Church of Christ.” Obama is merely “an ordinary apparatchik of the Democrat machine in Chicago” whose handlers intend to use Obama to bring upheaval and chaos to the nation. Basic journalist ethics require Fox News to terminate its contract with Kasich and treat him as a candidate for office in future broadcasts. Instead, Kasich remains a Fox News employee until June 1, 2009, when he formally launches his bid for governor of Ohio. He regularly promotes his candidacy on Fox broadcasts, most often on the highly rated O’Reilly Factor, where he is a frequent guest and sometime guest host. Fox News commentators frequently laud Kasich; on June 17, 2008, Republican political analyst and paid Fox contributor Frank Luntz says he is “hoping that Kasich runs for governor of Ohio. I think John would be an outstanding candidate.” On July 15, 2008, talk show host Sean Hannity tells Kasich: “I’m advocating that you run for governor one day. And you’re not.… You’re not going along at all.” Kasich will continue to appear as a regular guest on Fox News programming after he formally launches his bid and Fox terminates its contract with him. He will make frequent appearances on Hannity’s show, where Hannity calls him “governor” and “soon-to-be governor,” and holds a fundraiser for Kasich in October 2009. On The O’Reilly Factor, Fox will show the URL for Kasich’s campaign Web site. On July 8, 2009, Hannity will tell Kasich on air: “You do me a favor. Go get elected governor, although why you would ever want that job, you’re out of your mind, but good luck. And I’m supporting you in the effort.” Kasich will also receive two $10,000 contributions from News Corporation, the parent company of Fox News. Savage again lies to his listeners by telling them another oft-repeated falsehood, that Obama was educated in a radical Islamist “madrassah” during a childhood stint in Indonesia. Savage tells his listeners: “Look who we inherited in this country, from Dwight D. Eisenhower to Barack Hussein Obama, in one generation. A war hero to—a war hero who commanded the Allied operations against Nazi Germany was running for the presidency then. Now we have an unknown stealth candidate who went to a madrassas in Indonesia and, in fact, was a Muslim.… Yes, check it out.” [Media Matters, 4/7/2008] Weeks before, Savage told his listeners that Obama and his former pastor supported the Nazis and the Imperial Japanese, and Obama would bring chaos and devastation to the United States on a scale not seen since the Civil War (see March 13, 2008).

Former Bush administration press secretary Scott McClellan, in his book What Happened, provides his observations on the so-called “liberal media.” McClellan writes: “I’m often asked about the ‘liberal media’ critique. Is it true? Is the problem with Washington in part a result of the fact that left-wing journalists are, in effect, at war with conservative politicians and trying to bring them down? My answer is always the same.”
Less Pronounced Leftward Tilt to Reporting - “It’s probably true that most reporters, writers, and TV journalists are personally liberal or leftward leaning, and tend to vote Democratic,” he writes. “Polls and surveys of media professionals bear this out (see February 24, 2009). But this tilt to the left has probably become less pronounced in recent years, with the ascendancy of a wider variety of news sources, including Fox News.… And more important, everything I’ve seen, both as White House press secretary and as a longtime observer of the political scene and the media, suggests that any liberal bias actually has minimal impact on the way the American public is informed.” McClellan notes that, in his opinion, “the vast majority of reporters—including those in the White House press corps—are honest, fair-minded, and professional. They try hard to tell all sides of the stories they report (see March 6, 2003), and they certainly don’t treat information or statements coming from a conservative administration with excessive harshness or exaggerated skepticism. And even when a bit of bias does seep through, I believe the public sees it exactly for what it is.”
Press Corps 'Too Deferential to the White House' regarding Iraq - McClellan writes: “We in the Bush administration had no difficulty in getting our messages out to the American people. If anything, the national press corps was probably too deferential to the White House and the administration in regard to the most important decision facing the nation during my years in Washington, the choice over whether to go to war with Iraq. The collapse of the administration’s rationale for war, which became apparent months after our invasion, should have never come as such a surprise. The public should have been made much more aware, before the fact, of the uncertainties, doubts, and caveats that underlay the intelligence about the regime of Saddam Hussein. The administration did little to convey those nuances to the people; the press should have picked up the slack but largely failed to do so because their focus was elsewhere—on covering the march to war instead of the necessity of war. In this case, the ‘liberal case’ didn’t live up to its reputation. If it had, the country would have been better served.”
'Liberal-Oriented Media ... a Good Thing' for Countering Right-Leaning Administrations - He continues: “I’ll even go a step further. I’m inclined to believe that a liberal-oriented media in the United States should be viewed as a good thing. When I look back at the last several presidential administrations—the two Bushes, Bill Clinton, Ronald Reagan, Jimmy Carter, Gerald Ford—I see conservative/centrist leaders, either right of center or just left of center, who pursued mainstream policies designed to satisfy the vast bulk of middle-class American voters. All of these presidents were at least moderate on economic policy, generally pro-business in their orientation, and within the mainstream in most other issues, from foreign policy to education to the environment. And the Congressional leaders they worked with were, generally speaking, from the same mold—conservative or centrist. Over the past 50 years, there have been no flaming liberals in positions of greatest power in American politics.”
'Comforting the Afflicted and Afflicting the Comfortable' - “Under these circumstances, a generally liberal or left-leaning media can serve an important, useful role,” McClellan writes. “It can stand up for the interests of people and causes that get short shrift from conservative or mainstream politicians: racial and ethnic minorities, women, working people, the poor, the disenfranchised. As the old saying goes, a liberal reporter ought to take up the cause of ‘comforting the afflicted and afflicting the comfortable,’ speaking out on issues that otherwise would be neglected or ignored, exposing wrongdoing, and helping to keep the powerful in government and business honest.”
Welcomes 'Skeptical, Untrusting' Media - McClellan continues: “Furthermore, I welcome media that are skeptical and untrusting. The more so the better—as long as they are honest and fair. Those who are in positions of power should have to continually earn the trust of the governed. They should be constantly challenged to prove their policies are right, to prove they can be trusted, and to prove they are accountable. That is the way we are more likely to get to the important, sometimes hard truth.”
Fixation on 'Controversy' Obscures 'Larger Truths' - He concludes: “So I don’t agree with those who excoriate the ‘liberal media.‘… The real problem with the national media is their overemphasis on controversy, the excessive focus on who is winning and who is losing in Washington, and the constant search for something or someone to pick on and attack. These bad habits too often cause the larger truths that matter most to get lost in the mix.” [McClellan, 2008, pp. 156-158]

Angela McGlowan.Angela McGlowan. [Source: Women of the GOP]Fox News political analyst Angela McGlowan announces on the air that she is going back to Mississippi to “beat” US Representative Travis W. Childers (D-MS). Appearing on America’s Election Headquarters, she tells fellow contributor Bob Beckel: “That’s all right, sweetie, that’s my district, and I’m going there soon to beat your Democrat colleague, honey. I’m going soon. 2010 is my year. Announcing it right here.” Ethically, Fox should immediately terminate its contract with McGlowan, as she is now an announced candidate for public office. It is improper for Fox or any other journalistic outlet to continue having McGlowan on the air as a paid analyst or commentator once she announces for public office. Instead, Fox continues to pay McGlowan to appear on its programming until her contract expires in February 2010 and she “officially” announces her candidacy in Mississippi. Between May 2008 and February 2010, McGlowan makes dozens of appearances on Fox News and Fox Business Channel, where she regularly touts her candidacy and speaks as a candidate; on January 15, 2010, appearing on Fox Business with Neil Cavuto, she says she has held “four health care town hall meetings in the state of Mississippi” and adds: “[A] lot of people don’t want this health care bill. They want health care reform but they want the right type of reform.” During a February 6 appearance on America’s News Headquarters, McGlowan, still a paid contributor, actively solicits tea party votes and explains, “What I’m doing in essence is I’m concerned about Mississippi and the issues.” Even after she announces her candidacy and “terminates” her contract with Fox, she will continue to appear on its broadcasts as a candidate, including appearances on America’s Newsroom and Hannity; the first line of her first campaign release will reference her former Fox News employment. She receives a late endorsement from Fox News paid contributor Sarah Palin (R-AK). [Media Matters, 2/9/2010; Media Matters, 9/24/2010] On May 27, 2010, McGlowan will appear on America’s Newsroom, where host Bill Hemmer will introduce her as a “Fox News contributor” and ask her opinion of the Gulf of Mexico oil crisis. While she will criticize the Obama administration over it, calling it “Obama’s Katrina” and “Obama’s Watergate,” a chyron will identify McGlowan as a Congressional candidate. At the end of the segment, Hemmer will say, “Angela, I know you’re running for Congress in Mississippi, in the interest of full disclosure, we mention that, and thank you for coming on today.” [Media Matters, 5/27/2010] On June 1, 2010, McGlowan will come in a distant third in the Mississippi Republican primary, and will endorse Republican candidate Alan Nunnelee against Childers. [Source: AngryRenter (.com)]The Wall Street Journal learns that a supposedly amateur-based, citizen-driven protest Web site is actually a product of a professional public relations and lobbying organization, FreedomWorks (see April 14, 2009). The site, AngryRenter.com, is designed to look like something an “ordinary citizen” would produce. Michael Phillips of the Journal writes, “AngryRenter.com looks a bit like a digital ransom note, with irregular fonts, exclamation points, and big red arrows—all emphasizing prudent renters’ outrage over a proposed government bailout for irresponsible homeowners.” The site’s home page proclaims, “It seems like America’s renters may NEVER be able to afford a home,” and exhorts visitors to sign an online petition directed at Congressional Democrats. (The petition, with some 44,500 signatures, was delivered to Senate leaders earlier in the week.) “We are millions of renters standing up for our rights!” the site proclaims.
'Astroturf' - However, it is designed and hosted by FreedomWorks, which the Journal describes as “an inside-the-Beltway conservative advocacy organization led by Dick Armey, the former House majority leader, and publishing magnate Steve Forbes, a fellow Republican. [Forbes is an unpaid board member.]… [AngryRenter.com is] a fake grass-roots effort—what politicos call an astroturf campaign—that provides a window into the sleight-of-hand ways of Washington.” FreedomWorks opposes the proposed government bailout of the housing industry, and says it plans to oppose any further bailouts. AngryRenter.com is copyrighted by FreedomWorks, which discloses its ownership of the site on a page deeper into the site. However, Phillips writes, “The site is nonetheless designed to look underdoggy and grass-rootsy, with a heavy dose of aw-shucks innocence.” The site says: “Unfortunately, renters aren’t as good at politics as the small minority of homeowners (and their bankers) who are in trouble. We don’t have lobbyists in Washington, DC. We don’t get a tax deduction for our rent, and we don’t get sweetheart government loans.” Most visitors to the site have no idea that lobbyists for FreedomWorks actually wrote that copy, nor that FreedomWorks garnered $10.5 million in lobbying fees in 2006, most of which came from large donors the organization is not obligated to disclose.
FreedomWorks Operated by Millionaires - FreedomWorks president Matthew Kibbe says the site is an attempt to “reach out” to disgruntled renters who share the free-market views of Armey, Forbes, and others. Kibbe calls himself “an angry homeowner who pays his mortgage.” He lives on Capitol Hill in DC, in a home valued at $1.17 million. Forbes lives in a home in New Jersey worth $2.78 million, and owns, among other properties, a chateau in France. (The Forbes family recently sold its private island in Fiji and its palace in Morocco.) Armey earns over $500,000 a year working for FreedomWorks, and lives in a Texas home valued at $1.7 million. Representative Barney Frank (D-MA) says he finds it amusing that Armey is portraying himself as a champion of ordinary renters. “I worked a long time trying to improve the condition of renters,” he says. “Dick Armey has usually been on the other side.”
Looking Out for the 'Poor Devil' Who Can't Afford to Buy a Home - Armey says he’s looking out for “the poor devil” who can’t afford to buy a house. “From our point of view, we have an industry in which people were very careless, very reckless—both lenders and borrowers. What various policy makers are saying is we need to rush in here with a program to protect people from the consequences of their own bad judgment.”
Deliberately Misleading? - Armey defends AngryRenter.com’s deliberately amateurish appearance, and calls it “voluntary” for civic participation. San Diego financial adviser Rich Toscano, who rents his home, thought the site was an amateur venture similar to his own blog, Professor Piggington’s Econo-Almanac for the Landed Poor, which chronicles foreclosures and other financial misfortunes suffered by real-estate brokers whom Toscano says helped inflate the area’s real-estate bubble. AngryRenter.com appeared to Toscano as genuinely citizen-produced: “It looks like a young person did it,” he says. He still supports the site even after learning that it is a production of a DC lobbying firm, saying the message is more important than the identity of the bailout. Web designer Chris Kinnan, a FreedomWorks employee, actually designed the site. Of himself, he says: “I’m a renter. I’m not an angry renter.” [Wall Street Journal, 5/16/2008]

[Source: 640 WHLO-AM]As reported by progressive media watchdog site Media Matters, nationally syndicated radio host Mark Levin tells his listeners that presidential candidate Barack Obama “lied to” the American Israel Public Affairs Committee (AIPAC) when he “told them today that the Iranian Revolutionary Guards should be designated a terrorist group after voting against a bill designating them a terrorist group a year ago.” Fox News anchor Martha McCallum echoes the accusation a day later on her show The Live Desk, saying that Obama “seems to be changing his tune on the significant issue.” Both Levin and McCallum are misrepresenting Obama’s voting record. He has consistently voted to designate the Iranian Revolutionary Guards as a terrorist organization, and co-sponsored a November 2007 bill to do just that. Levin and McCallum are referencing a 2007 bill that Obama says he would have voted against, a bill that, Obama said, “states that our military presence in Iraq should be used to counter Iran.” Obama disagreed with that portion of the resolution, not another section that advocated for the designation of the Guards as a terrorist organization. The false characterization of Obama’s stance on the Guards may originate with Obama’s opponent John McCain, who says just before Levin’s broadcast that Obama “was categorical in his statement when he opposed that legislation. Then he goes before AIPAC and supports it. I know he’s changing on the surge, he’s trying to change on his pledge to negotiate with dictators without preconditions.” Levin flatly calls Obama “a liar… he’s a radical extremist and he’s a liar.” [Media Matters, 6/6/2008]

Conservative radio host Michael Savage says that homeless Americans should be put in “work camps.” As documented by progressive media watchdog organization Media Matters, Savage, answering a caller’s question about how he would address the “problem with the homelessness in this country,” says: “Why not put them in work camps? Most of them are able-bodied.” When the caller asks, “How much do you plan on paying them in these work camps, sir?” Savage responds, “Well, since they’re already receiving public assistance, I’d pay them nothing.” He continues: “Why do you have to pay a man who’s right now living off the fat of the land? And he’s sucking the fat of the land for, you know, a fairly small check—it is true—but he is a leech. He is not a productive member of society. Where is the money supposed to come from? No, I’ve studied the homeless problem for many years, Ed, because I live in one of the most infested cities in the United States—San Francisco—and I’ve observed the bums for many years. And the good—the largest portion of them are able-bodied. They’re drug addicts or alcoholics. There’s no reason they could not be put into work camps and do much of the labor that our illegal aliens are doing. Now, who do you think did this labor in previous generations? It was ne’er-do-wells, who today are basically able to live on the fat of the land and then drink or use drugs because they’re getting a check for nothing. His campaign is responding to persistent rumors that he is not a legitimate American citizen. In the process of releasing the certificate, Obama’s campaign also launches a Web site called Fight The Smears, devoted to debunking the allegations that, among other things, Obama is not a citizen, he is a closet Muslim, he took his oaths for political office on a copy of the Koran, he refuses to say the Pledge of Allegiance, and other falsehoods. As Obama was born in Kapiolani Maternity & Gynecological Hospital in Honolulu at 7:24 p.m. on August 4, 1961, his birth certificate comes under Hawaiian state law, and those laws state birth certificates are not public records. Only the individuals, or immediate family members, may request copies. The copy of the birth certificate released by the Obama campaign confirms that his name is legitimately “Barack Hussein Obama,” not “Barack Muhammed Obama,” “Barry Soetoro,” or other claimed variants, and states that Obama’s mother is Stanley Ann Dunham, an American, and his father is Barack Hussein Obama, an “African.” The birth certificate release only inflames the “birther” claims that Obama is hiding his true citizenship, religion, political alliances, and other such personal facts (see June 27, 2008). Crowley says: “[A]ccording to this genealogy—and again, because I haven’t done the research, I can’t verify this—but according to this guy Kenneth Lamb, Barack Obama is not black African, he is Arab African.… And yet, this guy is campaigning as black and painting anybody who dares to criticize him as a racist. The story has gained traction mostly through Internet blogs and emails circulating among far-right and “tea party” organizations and figures, making wildly varying claims—Obama is a Kenyan, he is a Muslim, his middle name is Mohammed, his birth name is “Barry Soetoro,” and so forth. PolitiFact’s Amy Hollyfield writes: “At full throttle, the accusations are explosive and unrelenting, the writers emboldened by the anonymity and reach of the Internet. And you can’t help but ask: How do you prove something to people who come to the facts believing, out of fear or hatred or maybe just partisanship, that they’re being tricked?” Hollyfield notes that PolitiFact has sought a valid copy of Obama’s birth certificate since the claims began circulating months ago. PolitiFact has already secured a copy of Obama’s 1992 marriage certificate from the Cook County, Illinois, Bureau of Vital Statistics, his driver’s license record from the Illinois secretary of state’s office, his registration and disciplinary record with the Attorney Registration & Disciplinary Commission of the Supreme Court of Illinois, and all of his property records. The records are consistent, all naming him as either “Barack H. Obama” or “Barack Hussein Obama,” his legitimate, given name. PolitiFact ran into trouble with the birth certificate. Obama was born in a hospital in Honolulu, Hawaii, and according to Hawaiian law, that state’s birth certificates are not public record. Only family members can request copies. The Obama presidential campaign originally declined to provide PolitiFact with a copy, until the campaign released a true copy of the certificate (see June 13, 2008). When PolitiFact received the document, researchers emailed it to the Hawaii Department of Health, which maintains such records, to ask if it was real. Spokesman Janice Okubo responded, “It’s a valid Hawaii state birth certificate.” Instead of settling the controversy, the certificate inflamed the so-called “birthers,” who asked a number of questions concerning the certificate, including queries about and challenges to:
bullet the certificate’s seal and registrar’s signature;
bullet the color of the document as compared to other Hawaiian birth certificates;
bullet the date stamp of June 2007, which some say is “bleeding through the back of the document,” supposedly calling into question the validity of the stamp and, thusly, the entire certificate;
bullet the lack of creases from being folded and mailed;
bullet the authenticity of the document, which some claim is “clearly Photoshopped and a wholesale fraud.”
Further investigation by PolitiFact researchers supports the validity of the certificate and disproves the allegations as cited. Hollyfield writes: “And soon enough, after going to every length possible to confirm the birth certificate’s authenticity, you start asking, what is reasonable here? Because if this document is forged, then they all are. If this document is forged, a US senator and his presidential campaign have perpetrated a vast, long-term fraud. They have done it with conspiring officials at the Hawaii Department of Health, the Cook County (Ill.) Bureau of Vital Statistics, the Illinois secretary of state’s office, the Attorney Registration & Disciplinary Commission of the Supreme Court of Illinois, and many other government agencies.” Hollyfield notes that the Hawaii Department of Health receives about a dozen email inquiries a day about Obama’s birth certificate, according to Okubo. She tells Hollyfield: “I guess the big issue that’s being raised is the lack of an embossed seal and a signature.” On a Hawaiian birth certificate, she says, the seal and signatures are on the back of the document. “Because they scanned the front… you wouldn’t see those things.” Hollyfield concludes that it is conceivable “that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies. Anything’s possible.” But she goes on to ask doubters “to look at the overwhelming evidence to the contrary and your sense of what’s reasonable has to take over. There is not one shred of evidence to disprove PolitiFact’s conclusion that the candidate’s name is Barack Hussein Obama, or to support allegations that the birth certificate he released isn’t authentic. And that’s true no matter how many people cling to some hint of doubt and use the Internet to fuel their innate sense of distrust.” [St. Petersburg Times, 6/27/2008]

Cappella, authors of the media study Echo Chamber: Rush Limbaugh and the Conservative Media Establishment, find that conservative radio host Rush Limbaugh excels at using what they call “insider language” for his listeners “that both embeds definitional assumptions hospitable to his conservative philosophy and makes it difficult for those who embrace the language to speak about Democrats and the presumed Democratic ideology without attacking them.” They cite three examples from Limbaugh’s June 2005 newsletter which contains the following statements:
bullet “Democrats are the enemy.”
bullet “When she first ran for her Senate seat, Hillary Rodham Clinton told citizens of the Empire State [New York] that she had been endorsed by environmental wacko-groups because… in her words, ‘I’ve stood for clean air.’”
bullet After Harvard president Lawrence Summers commented on the intrinsic differences between the sexes, Limbaugh wrote, “Led by foaming-at-the-mouth feminists, the liberal elite experienced a mass politically correct tantrum.”
Jamieson and Cappella write: “Identifying terms such as ‘foaming-at-the-mouth feminists,’ ‘liberal elite,’ ‘enemy,’ and ‘environmental wacko-groups’ both create an insider language and distance those who adopt the labels from those labeled. One of the ways Limbaugh’s supporters telegraph their identification with him is by adopting his language.”
Identifying Nicknames - They cite the 1995 statement of freshman House Representative Barbara Cubin (R-WY), who proudly proclaimed of her fellow female Republicans, “There’s not a femi-Nazi among us,” using one of Limbaugh’s favorite terms for feminists. “Listeners say ‘Ditto’ or ‘megadittoes’ to telegraph their enthusiasm for Limbaugh, his latest argument, or his show in general,” they write. Limbaugh refers to himself as “the MahaRushie” with “talent on loan from God.” Callers often refer to Limbaugh as “my hero.” Denigrating nicknames for Limbaugh’s targets of derision work to bring listeners into the fold: the new listener must labor to identify the people termed (and thusly become part of the Limbaugh community): “Clintonistas” (supporters of Bill and/or Hillary Clinton), “Sheets” (Senator Robert Byrd, D-WV), who in his youth wore ‘sheets’ as a Ku Klux Klan member), “the Swimmer” (Senator Edward Kennedy, D-MA, in reference to his involvement in the 1969 Chappaquiddick incident), “Puffster” (former Senator Tom Daschle, D-SD), “the Breck Girl” (former Senator John Edwards, D-NC), and “Ashley Wilkes” (retired General Wesley Clark, in a reference to what Limbaugh called “the wimpy, pathetic Gone with the Wind character”). Some of the nicknames are physically derogatory: Senator Patrick Leahy (D-VT) became “Senator Leaky, a.k.a. Senator Depends,” and former House Minority Leader Richard Gephardt (D-MO) became “‘Little Dick’ Gephardt.” Such use of “insider” nicknames indicates an identification between the listener and Limbaugh, and an affiliation with the Limbaugh community of supporters.
Redefining and Relabeling - Limbaugh routinely redefines and relabels his political enemies in the most derogatory terms. Pro-choice supporters are termed “pro-aborts,” and Democrats are supported by “beggar-based constituencies.” As noted above, feminists are “femi-Nazis” (though Jamieson and Cappella note that Limbaugh has used the term less often since it became a topic of criticism in the mainstream media).
Gender Identification - One of Limbaugh’s strongest attacks is on gender roles. In Limbaugh’s continuum, Democratic women are, the authors write, “either sexualized manipulators or unattractive man haters.” A 1994 Clinton tribute to women’s accomplishments became, in Limbaugh’s words, “Biddies’ Night Out.” Other times, Democratic women become “babes,” as in “Congressbabe Jane Harman.” (On his Web site, Limbaugh often shows Speaker of the House Nancy Pelosi (D-CA)‘s head affixed to the body of a Miss America contender.) The authors note, “Neither label invites the audience to take these leaders seriously.” Women with whom he disagrees, such as liberal blogger Arianna Huffington, are “screeching,” and others are “broads,” “lesbians,” or “femi-Nazis.” The National Organization for Women (NOW) becomes, in Limbaugh’s vocabulary, the NAGS. Attacks and innuendo about women’s sexuality are frequently used by Limbaugh: during the Clinton administration, for example, Limbaugh often implied that Hillary Clinton and then-Attorney General Janet Reno were closeted lesbians. On the other hand, Democratic men are routinely portrayed as “two-inchers,” derogatory references to their physical attributes and sexual capabilities (as with the Gephardt nickname above). Jamieson and Cappella note that “Limbaugh’s attempts at gender-based humor are of the locker room variety,” noting several references to California Lieutenant Governor Cruz Bustamante as a Democrat whose name translates into “large breasts,” and referring to pop singer Madonna’s 2004 endorsement of General Wesley Clark for president by saying she had “opened herself” to Clark. In 2004, he said that Democratic presidential contender John Kerry, married to wealthy heiress Teresa Heinz-Kerry, “does his fundraising every night when he goes to bed.” (The authors write, “Why the vulgarity in this message does not alienate the churchgoing conservatives in his audience is a question for which we have no ready answer.”)
Impact - Far from merely giving a laundry list of Limbaugh’s derogatory and offensive characterizations, Jamieson and Cappella note how Limbaugh and the conservative media “wrap their audiences in a conversation built on words and phrases that embody conservatism’s ideological assumptions,” using “naming and ridicule to marginalize those named as part of an out-group,” and using “coherent, emotion-evoking, dismissive language” to denigrate and dismiss the liberals he routinely attacks. “Because language does our thinking for us,” they write, “this process constructs not only a vocabulary but also a knowledge base for the audience. That language and the view of the world carried by it are presumed by loyal conservatives and alien to the nonconservative audience. These interpretations of people and events also reinforce Limbaugh’s defense of conservatism and its proponents.” [Washington Post, 2/15/1995; Jamieson and Cappella, 2008, pp. 184-190]
