After the failure of the US federal government under the Articles of Confederation, the men working to shape the new American government—later termed the “Founders”—determine that the new government must have a president with power equal to that of Congress and the Supreme Court. The federal government itself has far more power under the new Constitution than it had under the Articles, but many Founders worry that the government will have, or take upon itself, the power to constrain or even destroy individual rights and freedoms. The government, therefore, will have strict limitations on its functions, and will be divided into three co-equal branches. Debate over whether the new government should have a single president or an executive council rages, but eventually the Founders decide that a single president could best act decisively in times of crisis. However, Congress has the strength to curtail presidential power via legislation and oversight. One of the Founders’ most crucial decisions is to give Congress, not the president, the power to declare war and commit military troops to battle. Congress must also authorize any military actions that fall short of actual war, the creation and maintenance of armies, and exercise control over how the president can call on the armed forces in emergencies. Finally, the Founders, all too aware that until the English Revolution of 1688, the King of England could use his “prerogative powers” to dispense with a law that he felt unnecessary, move to ensure that the US president cannot use a similar usurpation of power to override Congressional legislation, writing in the Constitution that the president must “take care that the laws be faithfully executed.” In 2007, reporter Charlie Savage, drawing on James Madison’s Federalist Papers, will write: “Knowing that it was inevitable that from time to time foolish, corrupt, or shortsighted individuals would win positions of responsibility in the government, the Founders came up with a system that would limit anyone’s ability to become a tyrant or to otherwise wreck the country. And over the next century and a half, the system worked as the Founders had designed it to work.” [Savage, 2007, pp. 14-16]

James Madison, one of the founders of the American system of constitutional government (see 1787), writes of the importance of Congress, not the president, retaining the power to send the nation to war. “Those who are to conduct a war cannot, in the nature of things, be proper or safe judges,” he writes, “whether a war ought to be commenced, continued, or concluded. They are barred from the latter functions by a great principle in free government, analagous to that which separates the sword from the purse, or the power from executing from the power of enacting laws.” [Savage, 2007, pp. 19]

US states begin outlawing abortions, which have been practiced legally in most societies for thousands of years; at the time of the adoption of the US Constitution, abortions before “quickening” (i.e. birth) were commonly performed. In 2010, the National Abortion Federation will explain: “The motivations for anti-abortion laws varied from state to state. One of the reasons included fears that the population would be dominated by the children of newly arriving immigrants, whose birth rates were higher than those of ‘native’ Anglo-Saxon women.” As medical procedures were developed to increase the safety of both births and abortions, medical doctors began attempting to legally exclude practicioners such as homeopaths, midwives, and apothecaries from performing abortions, in part due to legitimate medical concerns and in part to ensure that they collected the fees paid by clients for abortions. In the late 1800s, the newly formed American Medical Association (AMA) argues that abortion is both immoral and dangerous. By 1910, all but one state has criminalized abortion except where necessary, in a doctor’s judgment, to save the woman’s life. “Back-alley,” or “criminal” abortions become commonplace, often performed by untrained “practitioners” in dangerous and unsanitary conditions or by the women themselves; many women are unnecessarily killed or injured during these procedures. Though in the mid-1960s some states will begin liberalizing their abortion laws, it will not be until 1973 that abortion becomes legal throughout the United States (see January 22, 1973). 1867: First Campaign Finance Bill Passed

The federal government enacts the Naval Appropriations Bill, the first attempt to regulate campaign finance. The bill prohibits officers and employees of the government from soliciting donations from Naval Yard workers. Congress passes the Civil Service Reform Act, also called the Pendleton Act, which expands on the previously passed Naval Appropriations Bill, which prohibited government officials and employees from soliciting campaign donations from Naval Yard workers (see 1867). This bill extends the law to cover all federal civil service workers. Before this law goes into effect, government workers are expected to make campaign contributions in order to keep their jobs. The law was prompted by the assassination of President James Garfield by a person who believed he had been promised a job in the Garfield administration. The law establishes a “merit system” in place of the old “patronage” system of receiving government posts. The presidential election is plagued with scandal and large monetary expenditures. William McKinley (R-OH) is the recipient of some $16 million in spending, a lavish amount for the time. The campaigns of both McKinley and his opponent, William Jennings Bryan (D-NE), are accused of bribery and poor ethical conduct. Mark Hanna, McKinley’s chief fundraiser and the chair of the Republican National Committee (RNC), devises a system of quotas for large corporations. Hanna raises between $6-7 million in donations from corporations through this quota system, in return for strong support of a big-business agenda. McKinley promises to oppose the establishment of silver coinage, supports protective tariffs, and other pro-corporate positions. The campaign is so fraught with controversy that the public begins demanding regulation and oversight of campaign funding practices. [Campaign Finance Timeline, 1999]

[Source: Library of Congress]In a speech given to an audience in Providence, Rhode Island, later entitled “The Control of Corporations,” President Theodore Roosevelt gives a passionate warning about the dangers of the nation’s prosperity being concentrated in the hands of the few, and particularly under the control of a few large corporations. Roosevelt says: “One of the features of the tremendous industrial development of the last generation has been the very great increase in private, and especially in corporate, fortunes.… Where men are gathered together in great masses it inevitably results that they must work far more largely through combinations than where they live scattered and remote from one another.… It is not true that the poor have grown poorer; but some of the rich have grown so very much richer that, where multitudes of men are herded together in a limited space, the contrast strikes the onlooker as more violent than formerly. On the whole, our people earn more and live better than ever before, and the progress of which we are so proud could not have taken place had it not been for the up building of industrial centers, such as this in which I am speaking. But together with the good there has come a measure of evil.… Under present-day conditions it is as necessary to have corporations in the business world as it is to have organizations, unions, among wage-workers. We have a right to ask in each case only this: that good, and not harm, shall follow. Exactly as labor organizations, when managed intelligently and in a spirit of justice and fair play, are of very great service not only to the wage-workers, but to the whole community, as has been shown again and again in the history of many such organizations; so wealth, not merely individual, but corporate, when used aright is not merely beneficial to the community as a whole, but is absolutely essential to the upbuilding of such a series of communities as those whose citizens I am now addressing.… The great corporations which we have grown to speak of rather loosely as trusts are the creatures of the state [the federal government], and the state not only has the right to control them, but it is in duty bound to control them wherever the need of such control is shown. There is clearly need of supervision—need to possess the power of regulation of these great corporations through the representatives of the public wherever, as in our own country at the present time, business corporations become so very powerful alike for beneficent work and for work that is not always beneficent. It is idle to say that there is no need for such supervision. There is, and a sufficient warrant for it is to be found in any one of the admitted evils appertaining to them.” Such government controls are rightfully difficult to put in place, Roosevelt says, because of the constitutional guarantees afforded both individuals and corporate entities, and because of the disparity of laws enacted in the various states. However, “I believe that the nation must assume this power of control by legislation; if necessary by constitutional amendment,” he says. “The immediate necessity in dealing with trusts is to place them under the real, not the nominal, control of some sovereign to which, as its creatures, the trusts shall owe allegiance, and in whose courts the sovereign’s orders may be enforced.” Such government regulation and oversight must be enforced with caution and restraint, he warns, but nevertheless, it must be enacted. [Theodore Roosevelt (.com), 8/23/1902; ed., 2003, pp. 20-21] Roosevelt’s position is ironic considering the vast corporate contributions he will accept to win the presidency in 1904 (he ascended to the presidency in 1901 after President William McKinley was assassinated). Roosevelt will accept large donations from railroad and insurance interests, and will make a personal appeal to steel baron Henry Clay Frick and other industrialists. Frick will later recall: “He got down on his knees to us. We bought the son of a b_tch and then he did not stay bought.” During his second term, Roosevelt will strive to pass significant campaign finance reform legislation that would ban some of the techniques he will use to regain office. President Theodore “Teddy” Roosevelt, in a speech given to the US Congress, proposes that corporations be expressly forbidden by law from contributing money “to any political committee or for any political purpose.” Neither should corporate directors be permitted to use stockholders’ money for political purposes. Roosevelt does not say that corporate owners should be so restricted. Roosevelt also says federal campaigns should be publicly financed via their political parties. Roosevelt’s proposal is made in part because he was accused of improperly accepting corporate donations for his 1904 presidential campaign. The Act prohibits monetary contributions to national political campaigns by corporations and national banks. Roosevelt, dogged by allegations that he had accepted improper donations during his 1904 presidential campaign, has pushed for such restrictions since he took office (see August 23, 1902 and December 5, 1905). [Federal Elections Commission, 1998; Center for Responsive Politics, 2002 pdf file; Moneyocracy, 2/2012] Senator Benjamin Tillman (D-SC), later described by National Public Radio as a “populist and virulent racist,” sponsored the bill. [National Public Radio, 2012] In 1900, Tillman was quoted as saying about black voters: “We have done our level best. We have scratched our heads to find out how we could eliminate every last one of them. We stuffed ballot boxes. We shot them. We are not ashamed of it.” [Atlas, 2010, pp. 205] Unfortunately, the law is easily circumvented. Businesses and corporations give employees large “bonuses” with the understanding that the employee then gives the bonus to a candidate “endorsed” by the firm. Not only do the corporations find and exploit this loophole, they receive an additional tax deduction for “employee benefits.” The law will be amended to cover primary elections in 1911 (see 1911). The Federal Corrupt Practices Act (FCPA), also called the Publicity Act, is passed. It will remain the backbone of American campaign finance regulation until expanded in 1925 (see 1925). It expands upon the Tillman Act’s prohibition against corporate and bank donations to federal election campaigns (see 1907) by enacting campaign spending limits on US House election campaigns. It also requires full disclosure of all monies spent and contributed during federal campaigns. In 1911, the FCPA will be amended to cover Senate elections as well, and to set spending limits on all Congressional races. However, the bill fails to provide for enforcement and verification procedures, so the law remains essentially useless. Lawmakers concerned with political reform push for amendments to the Tillman Act (see 1907) and Federal Corrupt Practices Act (FCPA—see June 25, 1910) that would extend those laws’ campaign finance restrictions to primary elections. Particularly strong in their support are reformers in the new Western and old Northern Republican-dominated states, who resent the Southern Democrats’ grip on their region of the country. Democrats have a powerful grip on the South, largely because few Southerners will countenance voting or campaigning as a Republican due to the Republican Party’s support for Reconstructionist policies after the Civil War. Southern Democrats are outnumbered in Congress, and unable to prevent the amendments from being passed. 1921: Supreme Court Weakens Campaign Finance Laws

In US v. Newberry, the Supreme Court finds some amendments to campaign finance laws (see 1911) unconstitutional, weakening the body of campaign finance law even further. The campaign finance laws in force (see 1907 and June 25, 1910) were already ineffective and rarely enforced by state attorneys general. And corporations and other special interests find it quite simple to circumvent the laws via loopholes. The case involves a Northern Republican primary race for the US Senate. Popular and powerful businessman Henry Ford (R-MI) lost the race due to enormous campaign expenditures and advertising by his opponent, and asked the US attorney general to intervene. The case stemming from Ford’s request results in the Court decision. The Court finds that the amendments are invalid because neither political parties nor election primaries are mentioned in the Constitution. The Founders had not considered having a two- or three-party system in place, and had envisioned the US as being governed by a single party that represented all interests. A two-party system did not emerge in American politics on a national scale until 1828. The Court, by maintaining a strict constitutional interpretation, sorely weakens campaign finance regulation. The federal government revises and expands the Federal Corrupt Practices Act (FCPA—see June 25, 1910), a campaign finance law that lacks any enforcement or verification mechanisms, in the wake of the Teapot Dome corruption scandal. The amended version codifies and revises the expenditure limits and disclosure procedures for US Congressional candidates. It will replace the original FCPA as well as its predecessor, the Tillman Act (see 1907), and will remain the backbone of American campaign finance law until 1971. All campaign spending is strictly regulated, with contributions of $50 and over during a calendar year mandated to be reported. Senatorial candidates can spend no more than three cents for each voter in the last election, to a maximum of $25,000. House candidates may also spend up to three cents per voter in the last election, up to a $5,000 maximum. Offers of patronage and contracts are banned, as is any form of bribery. Corporate contributions of all kinds are banned. However, the power of enforcement is entirely vested within Congress, and thusly is routinely ignored. Father Charles Coughlin.Father Charles Coughlin. [Source: Spartacus Schoolnet]Father Charles Edward Coughlin, an ordained Catholic priest, hosts what may be the first politically oriented national radio broadcast in US history. Coughlin, who started his political involvement as a supporter of President Roosevelt’s New Deal, quickly becomes a virulent Roosevelt critic, calling Roosevelt’s economic policies “socialism.” By 1930, CBS broadcasts Coughlin’s weekly radio show nationwide. Coughlin’s harsh criticism of communist and socialist governments, such as the Soviet Union, widens to encompass the US government and many aspects of American life. He accuses the citizenry of “scorn[ing] the basic family and national doctrine of Jesus Christ,” citing divorce statistics as “proof” of his assertions. He does not spare the corporations, blasting them for treating working families unfairly and warning of the dangers of the “concentration of wealth in the hands of the few.” Coughlin begins claiming that American communists have infiltrated many levels of government and corporate leadership, and lashes out at what he calls the “Bolshevism of America.” In April 1931, CBS refuses to renew his contract, and Coughlin organizes his own radio network which eventually claims over 30 radio stations and some 30 million listeners. In 1936, Coughlin, who has grown disillusioned with Roosevelt over his administration’s failure to take over the nation’s banking system and other of Coughlin’s suggested reforms, forms a hardline anti-Communist, isolationist organization called the “Christian Front.” When the US begins publicly opposing the German Nazi regime of Adolf Hitler, Coughlin turns on Roosevelt entirely, accusing him of advocating “international socialism or Sovietism,” and praising Hitler and Italy’s Benito Mussolini as “anti-Communist fighters.” By 1940, according to playwright Arthur Miller, Coughlin is “confiding to his 10 million Depression-battered listeners that the president was a liar controlled by both the Jewish bankers and, astonishingly enough, the Jewish Communists, the same tribe that 20 years earlier had engineered the Russian Revolution.… He was arguing… that Hitlerism was the German nation’s innocently defensive response to the threat of Communism, that Hitler was only against ‘bad Jews,’ especially those born outside Germany.” Coughlin echoes Nazi propagandist Joseph Goebbels in claiming that Marxist atheism in Europe is a Jewish plot. He claims that America is overrun by “Jewry,” resulting in critics labeling him a “fascist.” Boston police discover that for several years Jewish youths in the city have been beaten and terrorized by what the Christian Science Monitor calls “Coughlinites and the Christian Front”; other assaults on American Jews are later found to have been carried out by people who support Coughlin, often with the complicity of local law enforcement and Catholic officials. The Christian Front collapses in January 1940 when the FBI raids its New York branch and finds a cache of weapons; FBI Director J. Edgar Hoover tells the press that the organization is planning the assassinations of a number of prominent Jews, communists, and “a dozen Congressmen.” Coughlin’s influence is badly damaged by the FBI’s claims, and Coughlin’s rhetoric continues to move to the extreme. By September 1940, he is calling Roosevelt “the world’s chief warmonger,” and in 1941 says that the US, not Germany or the Soviet Union, is the biggest threat to impose its domination on the world. “Many people are beginning to wonder who they should fear most,” he says, “the Roosevelt-Churchill combination or the Hitler-Mussolini combination.” When the US enters World War II at the end of 1941, the National Association of Broadcasters arranges for Coughlin’s broadcasts to be terminated. At Roosevelt’s behest, the US Post Office refuses to deliver his weekly newspapers. And in May 1942, Coughlin is ordered by Archbishop Francis Mooney to cease his political activities or be defrocked. Although Coughlin will continue to write pamphlets about the dangers of communism until his death in 1979, his influence on American political thought ends in the first months of the war. American Liberty League logo.American Liberty League logo. [Source: David Pietrusza]Prominent Democrats and Republicans join together to form the American Liberty League (ALL). The organization, according to the founders, exists “to combat radicalism, preserve property rights, uphold and preserve the Constitution.” ALL spokesman Jouett Shouse says ALL will fight to preserve “traditional American political values.” According to the Encyclopedia of the Great Depression, ALL was organized by “disgruntled business conservatives, Wall Street financiers, right-wing opponents of Franklin D. Roosevelt’s New Deal, and defeated rivals within Roosevelt’s Democratic Party.” ALL is financed by, among others, industrialists Pierre, Irenee, and Lammot du Pont; former Democratic Party chairman John J. Raskob; financier E.F. Hutton; and executive Sewell Avery of the department store chain Montgomery Ward. Most of the politicians in the organization are Republicans, but these are joined by anti-Roosevelt Democrats such as Alfred E. Smith, who ran for president in 1928. Many ALL members were once part of the Association against the Prohibition Amendment, which fought to re-legalize the US liquor industry. ALL unsuccessfully fights to block federal regulations and additional taxes on business, the creation of public power utilities, pro-labor barganing rights, agricultural production controls and subsidies, New Deal relief and public jobs programs, the Works Progress Administration (WPA), Social Security, and other Roosevelt-era programs and initiatives. According to the Encyclopedia, “critics effectively lampooned league members as champions of privilege, ungrateful critics of an administration that had saved capitalism, and vindictive and selfish individuals seeking revenge on a president for betraying his social class.” ALL works diligently, but unsuccessfully, to unseat Roosevelt in 1936, backing Republican contender Alfred M. Landon. After Landon loses in a landslide to Roosevelt, the organization fades in prominence. The Encyclopedia concludes that ALL’s “legacy of fund-raising tactics, ideology-driven issues research and public education, and coordination with partisan legislative and electoral campaigns foreshadowed today’s political action committees and independent-expenditure organizations.” [New York Times, 8/23/1934; Encyclopedia of the Great Depression, 1/1/2004] In 2003, columnist Ralph De Toledano will write, “The Liberty League was laughed out of existence by New Yorker cartoonists, who depicted its members looking out over Fifth Avenue and snorting that doomsday was here and Josef Stalin lurked in the bushes.” [Insight, 9/2/2003] In 2010, writer Kevin Drum will compare the American Liberty League to the tea party movement (see September 2010). Congress passes the Public Utilities Holding Act, which bars public utility companies from making federal campaign contributions. Essentially, the act extends the ban on corporate contributions (see 1925) to utility companies, as they are not covered under existing law, and, under the administration of President Franklin Roosevelt, are growing rapidly in power and influence. Roosevelt had been elected to office in 1932 on a platform of “good government,” a longtime staple of Democratic Party platforms. The message played particularly well with voters after the economic policies and political corruption of the administration of President Herbert Hoover, a Republican, were widely blamed for the Great Depression. Republicans, stung by the failures of the Hoover administration, also declare their support for campaign finance reform, and the act passes with little resistance. [Campaign Finance Timeline, 1999]

Amendments to the federal Hatch Act of 1939, also known as the Clean Politics Act, set limits of $5,000 per year on individual contributions to a federal candidate or political committee. However, they do not prohibit donations from the same individual to multiple committees all working for the same candidate. The restrictions apply to primary elections as well as federal elections. Additionally, they bar contributions to federal candidates from individuals and businesses working for the federal government. The Smith-Connally Act restricts contributions to federal candidates from labor unions as well as from corporate and interstate banks (see 1925). The law is passed in response to the powerful influence of labor unions in elections beginning in 1936, where some unions used labor dues to support federal candidates [Center for Responsive Politics, 2002 pdf file] , and by public outrage at a steelworkers’ union going on strike for higher wages during the war, an action characterized by many as unpatriotic. The law was written both to punish labor unions and to make lawmakers less dependent on them and their contributions. [Campaign Finance Timeline, 1999] One example held up to scrutiny is the 1936 donation of $500,000 in union funds to the Democratic Party by John L. Lewis of the Congress of Industrial Organizations (CIO). [Connecticut Network, 2006 pdf file] Motivated by anti-union and anti-liberal sentiment after the war’s end, the Taft-Hartley Act (see June 23, 1947) will make the ban permanent. 1944: Labor Union Forms First PAC

The first “political action committee,” or PAC, is formed by the Congress of Industrial Organizations (CIO), a powerful labor union, on behalf of the efforts to re-elect President Franklin D. Roosevelt. PAC donations come from voluntary contributions and not labor dues, and therefore the donations are not prohibited (see June 25, 1943). [Source: Spectator]As World War II is coming to a close, the US Public Health Service (USPHS) begins a pilot program in Michigan to add fluoride to selected cities’ water supply, as a tooth-decay preventative. By 1950, 87 American towns and cities volunteer to have the agency fluoridate their water supply. By the early 1950s, water fluoridation is compulsory. Studies show that children between the ages of 5 and 9 show significantly smaller rates of cavities and tooth decay when they regularly drink fluoridated water, though studies of older children and adults are less clear. As the federal government begins rolling out its mandatory fluoridation program, far-right organizations such as the John Birch Society (JBS—see March 10, 1961 and December 2011) and the Ku Klux Klan (KKK) begin taking rigid stances against it. The JBS, a staunchly anti-Communist organization, accuses the federal government of imposing “creeping socialism” and “Soviet Communism” on the nation by making fluoridated water mandatory, and warns Americans against the government “polluting our precious bodily fluids.” (In 1993, JBS member Murray N. Rothbard differentiates between the brands of communism at work, saying, “[N]o, not Bolsheviks, guys: but a Menshevik-State Capitalist alliance.”) The JBS, in accusations later echoed by Rothbard, accuses the government of working with aluminum manufacturer Alcoa to dump sodium fluoride, a byproduct of aluminum manufacturing, into the nation’s water supply and rid Alcoa of the cost of disposing of the substance. The 1964 satirical film Dr. Strangelove features a character, General Jack D. Ripper, shouting, “Do you realize that fluoridation is the most monstrously conceived and dangerous Communist plot we have ever had to face?” [New American, 1/1993; Reason, 12/5/2001; Hileman, 5/2008] In 1988, the Fluoride Action Network notes that the two opposing camps—fluoridation is beneficial and has no side effects vs. fluoridation is useless and harmful—have fought to an argumentative standstill, with no middle ground between the two. Jacqueline Warren, an attorney with the National Resources Defense Council, says, “Neither side has given the other one rational moment.” [Hileman, 5/2008] In the early 1990s, environmentalist and public health safety groups begin calling for new examinations of the impact of fluoride on the human body, pointing to “valid concerns” about fluoride having a toxic impact on the human body and on the environment. In 2008, one JBS member warns, perhaps sardonically, “Don’t be surprised if we learn soon that the fluoride in Chinese toothpaste is nuclear waste from North Korea.” [Reason, 12/5/2001; Mother Jones, 5/2008]

The Taft-Hartley Act makes permanent the ban on contributions to federal candidates from unions (see June 25, 1943), corporations, and interstate banks (see 1925), and extends the regulations to cover primaries as well as general elections. It also requires union leaders to affirm that they are not supporters of the Communist Party. President Harry S. Truman unsuccessfully vetoed the bill when it was sent to his desk, and when Congress passes it over his veto, he echoes AFL-CIO leader John L. Lewis by denouncing the law as a “slave-labor bill.” Taft-Hartley declares the unions’ practice of “closed shops” illegal (employers agreeing with unions to hire only union members, and require employees to join the union), and permits unions to have chapters at a business only if approved by a majority of employees. The law also permits employers to refuse to bargain with unions if they choose. Board of Education of Topeka Supreme Court decision mandating the desegregation of American public schools, and is designed to pressure wavering Southern lawmakers into defying the Court’s decision as part of what researcher Tony Badger will later call “the massive resistance strategy so passionately advocated by the conservatives.” It is read aloud on the floor of the Senate by Walter George (D-GA), and was originally conceived by Senator Strom Thurmond (D-SC) with the assistance of his colleague Harry Byrd (D-VA), though the final version was tempered by a rewrite overseen by Senator Richard Russell (D-GA). The “Manifesto” declares that in certain instances, states are free to ignore federal laws and court decisions such as Brown v. Board. The document declares the Court decision an attempt to “substitute naked power for established law,” calls it “a clear abuse of judicial power,” and says that the states can and must defy the Court’s decision in the interest of establishing the rights of the states against the federal government. The principle of “separate but equal” treatment of white and black Americans, codified in an 1849 case and upheld by the 1896 Court decision in Plessy v. Ferguson, is, the signers state, “the established law of the land” and cannot be overturned by the current Court. It is up to the states, not the federal government, to determine if and when they will desegregate their separate school systems. Far from mandating equal treatment, the signers state, the Brown decision “destroys the amicable relations between the white and Negro races that have been created through 90 years of patient effort by the good people of both races,” and “has planted hatred and suspicion where there has been heretofore friendship and understanding.” The “judicial encroachment” of the decision must be resisted by “any lawful means,” they write. The signers conclude, “Even though we constitute a minority in the present Congress, we have full faith that a majority of the American people believe in the dual system of government which has enabled us to achieve our greatness and will in time demand that the reserved rights of the States and of the people be made secure against judicial usurpation,” and ask their supporters not to give in to the “agitators” determined to sow chaos and disorder in the name of desegregation. Disparate Group of Non-Signers - Cambridge University scholar Tony Badger will later write of the Southern lawmakers who refuse to sign the document, “The evidence from Texas, Tennessee, Florida, and North Carolina highlights the diversity of political opinion among the non-signers—from New Deal liberal to right-wing Republican ideologue—and the disparate sources for their racial moderation—national political ambitions, party loyalty, experience in the Second World War, Cold War fears, religious belief, and an urban political base.” [Badger, 4/1997]
Thurmond Calls NAACP 'Professional Racist Agitators,' Says Southern Whites Are Nation's 'Greatest Minority' - After the reading, Thurmond delivers a far less measured television address, calling the organization that brought the original lawsuit, the NAACP, a group of “professional racist agitators” and saying: “All of us have heard a great deal of talk about the persecution of minority groups. The white people of the South are the greatest minority in this nation. They deserve consideration and understanding instead of the persecution of twisted propaganda.” After his speech, one Georgia woman praises Thurmond’s “courage and wisdom,” and asks: “Wouldn’t it be possible to remove much of the Negro population from the South? I sincerely wish that this might be done, and would be glad to even contribute personally to the expense of such a plan.” [Cohodas, 1993, pp. 284-300]
Counterattack in Congress - In the following days, a succession of Northern Democrats lambast the manifesto on the Senate and House floor, and none of the signatories rise to speak in its defense. Wayne Morse (D-OR) says the document advocates nothing less than the “nullification” of the federal government, and if taken to its logical conclusion, the dissolution of the United States into 50 disparate entities. “If the gentlemen from the South really want to take such action,” he says, “let them propose a constitutional amendment that will deny to the colored people of the country equality of rights under the Constitution, and see how far they will get with the American people.” [Time, 3/26/1956; Cohodas, 1993, pp. 284-300] One Southern senator says shortly after its reading, “Now, if these Northerners won’t attack us and get mad and force us to close ranks, most of us will forget the whole thing and maybe we can pretty soon pretend it never happened.” [Time, 3/26/1956] The “Manifesto” heralds a split in the Democratic Party, between conservative, segregationist “Dixiecrat” Southerners and the moderate-to-liberal remainder of the party’s lawmakers. Thurmond will lead an exodus of the segregationists from the Democratic Party to the Republican Party shortly thereafter. [Cohodas, 1993, pp. 284-300]

In the case of United States v. Auto Workers, the Supreme Court reverses a lower court’s dismissal of an indictment against a labor union accused of violating federal laws prohibiting corporations and labor unions from making contributions or expenditures in federal elections (see June 23, 1947). Justice Felix Frankfurter writes the majority opinion; Chief Justice Earl Warren and Justices William O. Douglas and Hugo Black dissent. In a 5-3 decision, the Court finds the International Union United Automobile, Aircraft, and Agricultural Implement Workers of America liable for its practice of using union dues to sponsor television commercials relating to the 1954 Congressional elections. [UNITED STATES v. AUTO. WORKERS, 2011; Moneyocracy, 2/2012] Law professor Allison R. Hayward will later write that in her opinion the Court finding created “a fable of campaign finance reform… dictated by political opportunism. Politicians used reform to exploit public sentiment and reduce rivals’ access to financial resources.… [J]udges should closely examine campaign finance regulation and look for the improper use of legislation for political gain instead of simply deferring to Congress. Undue deference to the Auto Workers fable of reform could lead to punishment for the exercise of political rights. Correcting the history is thus essential to restoring proper checks on campaign finance legislation.” Hayward will argue that Frankfurter used a timeline of Congressional efforts to curb and reform campaign finance practices as an excuse to allow powerful political interests to exert restrictions on political opponents with less access to large election finance contributions. The US Supreme Court rules in Lassiter v. Northampton County Board of Elections that literacy tests for voting in North Carolina are constitutional. The case was brought by an African-American voter who argued that his right to vote was being unconstitutionally constrained. The Court rules that because the literacy test applies to all voters, it is legal (see April 25, 1898). A Time magazine profile lambasts the racist, anti-Communist John Birch Society (JBS—see December 2011), in what is many Americans’ first exposure to the group. It delineates the organization’s penchant for secrecy, its domination by its “dictatorial” leader, Robert Welch, and its hardline battle against almost every element of the federal government as “agents of Communism.” Forty to 60 percent of the federal government is controlled by Communism, the JBS believes. Time calls the organization “a tiresome, comic-opera joke” that nonetheless has cells in 35 states and an ever-widening influence. In Wichita, Kansas, JBS student members are trained to inform their cell leaders of “Communist” influences they may detect in their classroom lectures, and the offending teacher is berated by parents. A Wichita businessman who wanted to give a donation to the University of Wichita decided not to donate after being hounded by local JBS members, who wanted the university to fire professors and remove selected books from its library. “My business would be wrecked,” the businessman explains, “if those people got on the phone and kept on yelling that I am a Communist because I give money to the school.” Nashville, Tennessee, JBS members organize community members to verbally attack neighbors whom they suspect of Communist affiliations. JBS’s current priority, Time writes, is to bring about the impeachment of Chief Justice Earl Warren. Welch, who obtained his wealth from his brother’s candymaking business, believes that Social Security and the federal income tax are all part of the “creeping socialism” that is taking over the federal government. He retired from the business in 1957 and founded the JBS shortly thereafter, naming it for a US Navy captain killed by Chinese Communist guerrillas after the end of World War II. Welch’s seminal tract, “The Politician,” accuses President Eisenhower and his brother Milton Eisenhower of being Communist plants, and accuses both men of treason against the nation. [Source: Larry DeWitt]The American Medical Association (AMA) releases an 11-minute spoken-word album (LP) featuring actor and promising conservative politician Ronald Reagan. Reagan speaks against what he and the AMA call the “socialized medicine” of Medicare, currently being considered in Congress as part of legislation proposed by Democrats Cecil King and Clinton Anderson; many refer to the legislation as the King-Anderson bill. The AMA, along with most Congressional Republicans and a good number of Democrats, has been fighting the idea of government-provided health care since 1945 (see 1962).
Socialism Advancing under Cover of Liberal Policies - Reagan begins by warning that as far back as 1927, American socialists determined to advance their cause “under the name of liberalism.” King-Anderson is a major component of the secret socialist agenda, Reagan says. “One of the traditional methods of imposing statism or socialism on a people has been by way of medicine,” he says. “It’s very easy to disguise a medical program as a humanitarian project.” No real American wants socialized medicine, Reagan says, but Congress is attempting to fool the nation into adopting just such a program. It has already succeeded in imposing a socialist program on the country by creating and implementing Social Security, which was originally envisioned to bring “all people of Social Security age… under a program of compulsory health insurance.” Reagan, following the AMA’s position, says that the current “Eldercare” program, often called “Kerr-Mills” for its Congressional sponsors, is more than enough to cover elderly Americans’ medical needs. (Author Larry DeWitt notes that in 1965, Kerr-Mills will be superseded by Medicaid, the medical program for the poor. He will write, “So Reagan—on behalf of the AMA—was suggesting that the nation should be content with welfare benefits under a Medicaid-type program as the only form of government-provided health care coverage.”) King-Anderson is nothing more than “simply an excuse to bring about what [Democrats and liberals] wanted all the time: socialized medicine,” Reagan says. And once the Medicare proposal of King-Anderson is in place, he argues, the government will begin constructing an entire raft of socialist programs, and that, he says, will lead to the destruction of American democracy. “The doctor begins to lose freedom,” he warns. “First you decide that the doctor can have so many patients. They are equally divided among the various doctors by the government. But then doctors aren’t equally divided geographically. So a doctor decides he wants to practice in one town and the government has to say to him, you can’t live in that town. They already have enough doctors. You have to go someplace else. And from here it’s only a short step to dictating where he will go.… All of us can see what happens once you establish the precedent that the government can determine a man’s working place and his working methods, determine his employment. From here it’s a short step to all the rest of socialism, to determining his pay. And pretty soon your son won’t decide, when he’s in school, where he will go or what he will do for a living. He will wait for the government to tell him where he will go to work and what he will do.” DeWitt will note that this is far more extravagant than any of the Medicare proposals ever advanced by any lawmaker: “It was this more apocalyptic version of Medicare’s potential effects on the practice of medicine that Reagan used to scare his listeners.”
Advocating Letter-Writing Campaign - Reagan tells his listeners that they can head off the incipient socialization of America by engaging in a nationwide letter-writing campaign to flood Congress with their letters opposing King-Anderson. “You and I can do this,” he says. “The only way we can do it is by writing to our congressman even if we believe he’s on our side to begin with. Write to strengthen his hand. Give him the ability to stand before his colleagues in Congress and say, ‘I heard from my constituents and this is what they want.’”
Apocalypse - If the effort fails, if Medicare passes into law, the consequences will be dire beyond imagining, Reagan tells his audience: “And if you don’t do this and if I don’t do it, one of these days you and I are going to spend our sunset years telling our children, and our children’s children, what it once was like in America when men were free.” Reagan is followed up by an unidentified male announcer who reiterates Reagan’s points and gives “a little background on the subject of socialized medicine… that now threatens the free practice of medicine.” Reagan then makes a brief closing statement, promising that if his listeners do not write those letters, “this program I promise you will pass just as surely as the sun will come up tomorrow. And behind it will come other federal programs that will invade every area of freedom as we have known it in this country, until, one day… we will awake to find that we have socialism. And if you don’t do this, and if I don’t do it, one of these days, you and I are going to spend our sunset years telling our children, and our children’s children, what it once was like in America when men were free.” [Larry DeWitt, 9/2004; TPMDC, 8/25/2009]

Cleon Skousen, a supporter of the John Birch Society (JBS—see December 2011), writes an article attacking the Time profile of the JBS (see March 10, 1961) as being part of an orchestrated Communist attack on the organization. The article came about after the international Communist Party “ordered” the “annihilation” of the JBS, Skousen says. Skousen denies the group’s penchant for secrecy, saying that it was openly set up in 1958 as a network of “study groups” examining the threat of Communism to American society. The organization, he writes, is nothing more than “a study group program with a strong bias in favor of traditional American constitutionalism.” By 1960, the JBS earned the enmity of competing conservative groups, Skousen says, because the organization “had rallied together most of the best informed and hardest working patriots in many cities.” However, he writes, JBS members tend to be part of other conservative movements as well. The JBS worked to defeat a bill, slated to be introduced in January 1961, that would largely defund the House Committee on Un-American Activities “so it could not investigate the Communist Party.” Skousen says that JBS efforts derailed the bill, handing the American Communist Party “an overwhelming defeat.” After the bill was defeated, Skousen says, “a manifesto… from Moscow” ordered the destruction of the JBS, as it posed the primary danger to “Communist progress” in the US. The Time magazine profile of the JBS was part of that effort, Skousen says, after the organization was attacked in the pages of the Daily People’s World, a West Coast publication that Skousen says was “the official Communist newspaper” of that area. Within days, the information in the article was reprinted in Time’s own article, which reached far more people than the People’s World. “[T]he thing which astonished me,” Skousen writes, “was the rapidity with which the transmission belt began to function so that this story was planted in one major news medium after another until finally even some of the more conservative papers had taken up the hue and cry.” Skousen calls the article a Communist plant filled with fabrications and lies. He says that JBS leader Robert Welch’s accusations that President Eisenhower and other pro-American world leaders are Communists were made in “private communication[s] to his friends” and were never part of official JBS principles, and took place well before Welch founded the JBS in 1957; therefore, Skousen writes, to report Welch’s characterizations is to smear the JBS. Skousen also denies any racism or anti-Semitism on the JBS’s part, and uses a sympathetic 1963 report by the California Senate Factfinding Committee to “prove” his claims. The report concluded that Welch and the JBS have “stirred the slumbering spirit of patriotism in thousands of Americans, roused them from lethargy, and changed their apathy into a deep desire to first learn the facts about communism and then implement that knowledge with effective and responsible action.” Skousen concludes that while Americans are free to disagree with JBS principles and actions, any criticism of the organization should be considered potential Communist propaganda designed to smear the organization and reduce its effectiveness. If the criticism does not come from Communists themselves, it plays into Communist hands. As he claims to have been told by “[a] former member of the Communist Party National Committee,” “The Communist leaders look upon the stamping out of the John Birch Society as a matter of life and death for the Party.” [Our Republic, 1963]

The poster distribution is timed to coincide with Kennedy’s visit to Dallas, where he is scheduled to drive through the city in a motorcade on November 22. Kennedy will be assassinated during that motorcade. The poster, designed to appear as a “Wanted” notice, enumerates the following “charges” against Kennedy:

President Lyndon Johnson signs the Voting Rights Act (VRA) into law. Based on the Fifteenth Amendment (see February 26, 1869), the VRA is a potent set of statutes that permanently bars direct barriers to political participation by racial and ethnic minorities. It bans any election practice that denies the right to vote due to race, and requires areas with a history of racial discrimination to get federal approval of changes in their election laws before they can take effect. The VRA forbids literacy tests (see 1896, April 25, 1898, and June 8, 1959) and other barriers to registration that have worked to stop minority voters from exercising their rights (see 1888, June 21, 1915, and February 4, 1964). Sections 2 and 5 of the VRA work together to prohibit states from establishing voting qualifications or standards that interfere with a citizen’s right to vote on a racial basis. Section 5 requires states with a history of racial discrimination to obtain “preclearance” from the Justice Department before altering any laws pertaining to voting—this includes changing electoral districts, voter qualification rules, and even changes in government structure such as making a formerly elective office appointive. If the changes can be seen as possibly “diluting” minority voting strength, they can be disallowed. States wishing to challenge the VRA restrictions have the opportunity to have their cases heard in federal court. Section 2 has similar, if less restrictive, provisions that apply nationally. Section 10 of the VRA takes direct aim at the Breedlove ruling from the Supreme Court (see December 6, 1937), which had legitimized poll taxes used to disenfranchise minority voters. That portion of the VRA finds that poll taxes “impose… unreasonable financial hardship” and “precludes persons of limited means from voting.” The VRA also forbids the use of literacy tests, good character tests, and other such tests used in the past to suppress minority voting. The law urges the attorney general to urge the Court to overrule Breedlove; minutes after Johnson signs the bill into law, he directs the attorney general “to file a lawsuit challenging the constitutionality of the poll tax.” The Court will find poll taxes unconstitutional in its Harper v. Virginia Board of Elections ruling (see March 24, 1966). The US Department of Justice and the federal courts now have the power to monitor problem jurisdictions and assist private citizens in seeking redress through the courts if their voting rights are infringed. Ailes suggests “[s]ome guy to sit there and say, ‘Awright, Mac, what about these n_ggers?’” According to Nixonland author Rick Pearlstein, the idea is to have Nixon “abhor the uncivility of the words, while endorsing a ‘moderate’ version of the opinion.” [Pearlstein, 5/2008, pp. 331; Media Matters, 7/22/2011] The suggestion is not used. White House Chief of Staff H. R. Haldeman begins setting up a secret campaign fund for the 1970 and 1972 elections. The source of the funding is to be, in its initial phases, money from billionaire oilman J. Paul Getty. Haldeman writes to fellow Nixon aide John Ehrlichman: “Bebe Rebozo [Nixon’s close friend] has been asked by the president to contact J. Paul Getty in London regarding major contributions.… The funds should go to some entity other than the [Republican] National Committee so that we retain full control of their use.” [Reeves, 2001, pp. 40]

President Nixon orders chief of staff H. R. Haldeman to finalize the creation of a second secret campaign fund (see February 17, 1969). The purpose of this particular fund is to support candidates in the November 1970 midterm elections that Nixon believes are loyal to him. The idea is not necessarily to support Republicans, but to support Nixon loyalists—party is a secondary consideration. “One of our most important projects for 1970 is to see that our major contributors funnel all their funds through us,” Nixon writes. “[W]e can see that they are not wasted in overheads or siphoned off by some possible venal types on the campaign committees… we can also see that they are used more effectively than would be the case if the candidates receive them directly.” The candidates’ fund, eventually dubbed the “Townhouse Operation” or “Town House Project” (so named because all of its dealings must take place in private offices and not in the White House or any campaign offices (see Early 1970)), is to be operated by Haldeman, Secretary of Commerce Maurice Stans (himself a veteran campaign fund-raiser), Senator Strom Thurmond (R-SC)‘s aide Harry Dent, and Dent’s assistant John Gleason. The list of contributors includes Chicago insurance tycoon W. Clement Stone, PepsiCo’s Donald Kendall, and Texas electronics millionaire H. Ross Perot. “Townhouse” is not the only secret campaign fund run from the White House; another is run by Nixon’s close friend millionaire Charles “Bebe” Rebozo, and features $50,000 secretly flown to Nixon’s beach home in Key Biscayne, Florida by an employee of billionaire Howard Hughes. President Richard Nixon writes an action memo to senior aide H. R. Haldeman saying, “One of our most important projects for 1970 is to see that our major contributors funnel all their funds through us.” Haldeman and Commerce Secretary Maurice Stans set up a secret fund-raising enterprise, the “Townhouse Operation,” designed to bypass the Republican National Committee. By doing so, Nixon intends to ensure the GOP will field candidates suitably loyal to him, and reliably opposed to the GOP’s traditional Eastern Establishment base that Nixon so resents. Although George H. W. Bush is a charter member of that Eastern Establishment, Nixon likes and trusts him. Bush is “a total Nixon man,” Nixon once says. “He’ll do anything for the cause.” Bush is the main beneficiary of the slush fund, which is made up of about $106,000 in contributions from Texas GOP sources, but up to 18 other Republican Senate candidates also receive money from the fund. The Wall Street Journal will later lambast Townhouse, calling it a “dress rehearsal for the campaign finance abuses of Watergate, as well as for today’s loophole-ridden system.” [Werth, 2006, pp. 115-116]

To that end, he has his personal lawyer, Herbert Kalmbach, ferry $100,000 in secret campaign funds (see December 1, 1969) to Alabama gubernatorial candidate Albert Brewer. Kalmbach delivers the money in the lobby of a New York City hotel, using the pseudonym “Mr. Jensen of Detroit.” Through his chief of staff H. R. Haldeman, Nixon also orders an IRS investigation of Wallace. White House aide Murray Chotiner delivers the information gleaned from the IRS probe to investigative columnist Jack Anderson, who subsequently prints the information in his syndicated columns. When Brewer forces a runoff with Wallace in the May 5 primary elections, Kalmbach has another $330,000 delivered to Brewer’s campaign. Brewer’s aide Jim Bob Solomon takes the money, in $100 bills, to Brewer via a flight from Los Angeles to Alabama; Solomon is so worried about the money being discovered in the event of a plane crash that he pins a note to his underwear saying that the money is not his, and he is delivering it on behalf of the president. Wallace, calling Brewer “the candidate of 300,000 n_ggers,” wins the runoff despite the massive cash infusions from the White House. [Reeves, 2001, pp. 228-229]

Roger Ailes, the senior media consultant for the Nixon administration (see 1968), writes, or helps write, a secret memo for President Nixon and fellow Republicans outlining a plan for conservatives to “infiltrate and neutralize” the mainstream American media. The document will not be released until 2011; experts will call it the “intellectual forerunner” to Fox News, which Ailes will launch as a “fair and balanced” news network in 1996 (see October 7, 1996). John Cook, the editor of the online news and commentary magazine Gawker, will call the document the outline of a “nakedly partisan… plot by Ailes and other Nixon aides to circumvent the ‘prejudices of network news’ and deliver ‘pro-administration’ stories to heartland television viewers.” The document is entitled “A Plan for Putting the GOP on TV News.” Ailes, currently the owner of REA Productions and Ailes Communications Inc., works for the Nixon White House as a media consultant; he will serve the same function for President George H.W. Bush during his term. Ailes is a forceful advocate for using television to shape the message of the Nixon administration and of Republican policies in general. He frequently suggests launching elaborately staged events to entice favorable coverage from television reporters, and uses his contacts at the news networks to head off negative publicity. Ailes writes that the Nixon White House should run a partisan, pro-Republican media operation—essentially a self-contained news production organization—out of the White House itself. He complains that the “liberal media” “censors” the news to portray Nixon and his administration in a negative light. Cook will say the plan “reads today like a detailed precis for a Fox News prototype.” The initial idea may have originated with Nixon chief of staff H.R. Haldeman, but if so, Ailes expands and details the plan far beyond Haldeman’s initial seed of an idea. [Roger Ailes, 1970; Gawker, 6/30/2011] In 2011, Rolling Stone journalist Tim Dickinson will write: “This is an astounding find. It underscores Ailes’s early preoccupation with providing the GOP with a way to do an end run around skeptical journalists.” [Rolling Stone, 7/1/2011]
Focus on Television - Ailes insists that any such media plan should focus on television and not print. Americans are “lazy,” he writes, and want their thinking done for them: “Today television news is watched more often than people read newspapers, than people listen to the radio, than people read or gather any other form of communication. The reason: People are lazy. With television you just sit—watch—listen. The thinking is done for you.” Ailes says the Nixon administration should create its own news network “to provide pro-administration, videotape, hard news actualities to the major cities of the United States.” Other television news outlets such as NBC News, ABC News, CBS News, and PBS News, are “the enemy,” he writes, and suggests going around them by creating packaged, edited news stories and interviews directly to local television stations. (Years later, these kinds of “news reports” will be called “video news releases,” or VNRs, and will routinely be used by the George W. Bush administration and others—see March 15, 2004, May 19, 2004, March 2005, and March 13, 2005. They will be outlawed in 2005—see May 2005.) “This is a plan that places news of importance to localities (senators and representatives are newsmakers of importance to their localities) on local television news programs while it is still news. It avoids the censorship, the priorities, and the prejudices of network news selectors and disseminators.” Ailes and his colleagues include detailed cost analyses and production plans for such news releases. In a side note on the document, Ailes writes: “Basically a very good idea. It should be expanded to include other members of the administration such as cabinet involved in activity with regional or local interest. Also could involve GOP governors when in DC. Who would purchase equipment and run operation—White House? RNC [Republican National Committee]? Congressional caucus? Will get some flap about news management.”
Dirty Tricks - Ailes suggests planting “volunteers” within the Wallace campaign, referring to segregationist George Wallace (D-AL), whose third-party candidacy in 1968 almost cost Nixon the presidency. Ailes knows Wallace is planning a 1972 run as well, and is apparently suggesting a “mole” to either gather intelligence, carry out sabotage, or both. (Wallace’s plans for another run will be cut short by an assassination attempt—see May 15, 1972.) Ailes also suggests having his firm film interviews with Democrats who support Nixon’s Vietnam policies, such as Senators John Stennis (D-MS) and John McClellan (D-AR). Though Stennis and McClellan would believe that the interviews were for actual news shows, they would actually be carried out by Ailes operatives and financed by a Nixon campaign front group, the “Tell it to Hanoi Committee.” In June 1970, someone in the Nixon administration scuttles the plan, writing: “[T]he fact that this presentation is White House directed, unbeknownst to the Democrats on the show, presents the possibility of a leak that could severely embarrass the White House and damage significantly its already precarious relationship with the Congress. Should two powerful factors like Stennis and McClellan discover they are dupes for the administration the scandal could damage the White House for a long time to come.”
Volunteers to Head Program - Ailes writes that he wants to head any such “news network,” telling Haldeman: “Bob—if you decide to go ahead we would as a production company like to bid on packaging the entire project. I know what has to be done and we could test the feasibility for 90 days without making a commitment beyond that point.” Haldeman will grant Ailes’s request in November 1970, and will give the project a name: “Capitol News Service.” Haldeman will write: “With regard to the news programming effort as proposed last summer, Ailes feels this is a good idea and that we should be going ahead with it. Haldeman suggested the name ‘Capitol News Service’ and Ailes will probably be doing more work in this area.” Documents fail to show whether the “Capitol News Service” is ever actually implemented. Television News Incorporated - Ailes will be fired from the Nixon administration in 1971; he will go on to start a similar private concern, “Television News Incorporated” (TVN—see 1971-1975), an ideological and practical predecessor to Fox News. Dickinson will write: “More important, [the document] links the plot to create what would become Television News Incorporated—the Ailes-helmed ‘fair and balanced’ mid-1970s precursor to Fox News—to the Nixon White House itself.” [Gawker, 6/30/2011; Rolling Stone, 7/1/2011] A former business colleague of Ailes’s will say in 2011: “Everything Roger wanted to do when he started out in politics, he’s now doing 24/7 with his network [Fox News]. It’s come full circle.” [Rolling Stone, 5/25/2011]

President Nixon approves the “Huston Plan” for greatly expanding domestic intelligence-gathering by the FBI, CIA and other agencies. Four days later he rescinds his approval. [Washington Post, 2008] Nixon aide Tom Charles Huston comes up with the plan, which involves authorizing the CIA, FBI, NSA, and military intelligence agencies to escalate their electronic surveillance of “domestic security threats” in the face of supposed threats from Communist-led youth agitators and antiwar groups (see June 5, 1970). The plan would also authorize the surreptitious reading of private mail, lift restrictions against surreptitious entries or break-ins to gather information, plant informants on college campuses, and create a new, White House-based “Interagency Group on Domestic Intelligence and Internal Security.” Huston’s Top Secret memo warns that parts of the plan are “clearly illegal.” Nixon approves the plan, but rejects one element—that he personally authorize any break-ins. Nixon orders that all information and operations to be undertaken under the new plan be channeled through his chief of staff, H. R. Haldeman, with Nixon deliberately being left out of the loop. The first operations to be undertaken are using the Internal Revenue Service to harass left-wing think tanks and charitable organizations such as the Brookings Institution and the Ford Foundation. Huston writes that “[m]aking sensitive political inquiries at the IRS is about as safe a procedure as trusting a whore,” since the administration has no “reliable political friends at IRS.” He adds, “We won’t be in control of the government and in a position of effective leverage until such time as we have complete and total control of the top three slots of the IRS.” Huston suggests breaking into the Brookings Institute to find “the classified material which they have stashed over there,” adding: “There are a number of ways we could handle this. There are risks in all of them, of course; but there are also risks in allowing a government-in-exile to grow increasingly arrogant and powerful as each day goes by.” [Reeves, 2001, pp. 235-236] In 2007, author James Reston Jr. will call the Huston plan “arguably the most anti-democratic document in American history… a blueprint to undermine the fundamental right of dissent and free speech in America.” [Reston, 2007, pp. 102]

The federal government enacts the Revenue Act as a companion, and precursor, to the omnibus Federal Election Campaign Act (FECA—see February 7, 1972). The Revenue Act creates a public campaign fund for eligible presidential candidates, beginning with the 1976 presidential election, through the provision of a voluntary one-dollar checkoff box on federal income tax returns. (This provision was actually introduced into law by the 1968 Long Act.) The law also allows for a $50 tax deduction for individual filers for contributions to local, state, or federal candidates, a provision that will be eliminated in 1978. It provides a $12.50 tax credit for the same purpose, a provision that will be raised to $50 in 1978 and eliminated in 1986. President Nixon, regretting his removal of the secret tape recorders in the White House left behind by former president Lyndon Johnson, orders the installation of a sophisticated, secret taping system in the Oval Office and Cabinet Room, which will, when activated, record every spoken word and telephone conversation in either chamber (see July 13-16, 1973). The Oval Office’s microphones will be voice-activated; the Cabinet Room’s with a switch. Nixon orders his chief of staff H. R. Haldeman to see to the installation, and to keep it extremely quiet. Haldeman delegates the installation to aides Lawrence Higby and Alexander Butterfield. Haldeman decides the Army Signal Corps should not install the system because someone in that group might report back to the Pentagon; instead he has the Secret Service’s technical security division install it. The work is done late at night; five microphones are embedded in Nixon’s Oval Office desk, and two more in the wall light fixtures on either side of the fireplace, over the couch and chairs where Nixon often greets visitors. All three phones are wiretapped. By February 16, the system in both chambers is in place. All conversations are recorded on Sony reel-to-reel tape recorders, with Secret Service agents changing the reels every day and storing the tapes in a small, locked room in the Executive Office Building. [Source: Daniel Ellsberg]The New York Times receives a huge amount of secret Defense Department documents and memos that document the covert military and intelligence operations waged by previous administrations in Vietnam (see January 15, 1969). The documents are leaked by Daniel Ellsberg, a former Defense Department official who worked in counterintelligence and later for the RAND Corporation while remaining an active consultant to the government on Vietnam. Ellsberg, a former aide to Secretary of State and National Security Adviser Henry Kissinger and a member of the task force that produced the Defense Department documents, has, over his tenure as a senior government official, become increasingly disillusioned with the actions of the US in Vietnam. [Herda, 1994] The documents are given to Times reporter Neil Sheehan by Ellsberg (see May 1969). [Bernstein and Woodward, 1974, pp. 313]
Ellsberg Tried to Interest Senators - After he and his friend Anthony Russo had copied the documents (see September 29, 1969), Ellsberg had spent months attempting to persuade several antiwar senators, including William Fulbright (D-AR), Charles Mathias Jr (R-MD), George McGovern (D-SD), and Paul “Pete” McCloskey (R-CA), to enter the study into the public record, all to no avail. But McGovern suggested that Ellsberg provide copies of the documents either to the New York Times or the Washington Post. Ellsberg knew Sheehan in Vietnam, and decided that the Times reporter was his best chance for making the documents public. [Reeves, 2001, pp. 333; Moran, 2007] Ellsberg originally gave copies of the documents—later dubbed the “Pentagon Papers”—to Phil Geyelin of the Washington Post, but the Post’s Katherine Graham and Ben Bradlee decided not to publish any of the documents. Ellsberg then gave a copy to Sheehan.
Documents Prove White House Deceptions - The documents include information that showed former President Dwight D. Eisenhower had made a secret commitment to help the French defeat the insurgents in Vietnam. They also show that Eisenhower’s successor, John F. Kennedy, had used a secret “provocation strategy” to escalate the US’s presence into a full-blown war that eventually led to the infamous Gulf of Tonkin incident. The documents also show that Kennedy’s successor, Lyndon Johnson, had planned from the outset of his presidency to expand the war [Spartacus Schoolnet, 8/2007] , and show how Johnson secretly paved the way for combat troops to be sent to Vietnam, how he had refused to consult Congress before committing both ground and air forces to war, and how he had secretly, and illegally, shifted government funds from other areas to fund the war. Finally, the documents prove that all three presidents had broken Constitutional law in bypassing Congress and sending troops to wage war in Vietnam on their own authority. [Herda, 1994]
Times Publishes Against Legal Advice - The Times will begin publishing them in mid-June 1971 (see June 13, 1971) after putting Sheehan and several other reporters up in the New York Hilton to sift through the mountain of photocopies and the senior editors, publishers, and lawyers argued whether or not to publish such a highly classified set of documents. The management will decide, against the advice of its lawyers, to publish articles based on the documents as well as excerpts from the documents themselves. [Moran, 2007]

Nixon and his staff members have secretly colluded with AMPI members to artificially drive up the price of milk in return for $2 million in campaign contributions for Nixon’s 1972 re-election. (Ironically, in 1968, AMPI had supported Democratic candidate Hubert Humphrey, but they now want access to Nixon, and retained former Nixon aide Murray Chotiner as soon as Chotiner left the White House.) In 1969 and 1970, AMPI officials delivered $235,000 to Nixon’s personal lawyer, Herbert Kalmbach, for use in the Townhouse Project (see Early 1970) and other secret campaign operations. AMPI officials agree to government subsidies that will drive the price of milk up to $4.92 per hundredweight after politely listening to Nixon’s ideas of marketing milk as a sedative: “If you get people thinking that a glass of milk is going to make them sleep, I mean, it’ll do just as well as a sleeping pill. It’s all in the head.” Nixon heads off specific discussions of how AMPI money will be delivered, warning: “Don’t say that while I’m sitting here. Matter of fact, the room’s not tapped. Forgot to do that” (see February 1971). After the meeting, Nixon’s aides calculate that the deal will cost the government about $100 million. White House aide John Ehrlichman says as he leaves Nixon’s office: “Better get a glass of milk. Drink it while it’s cheap.” That evening, Chotiner and the president of AMPI, Harold Nelson, transfer the $2 million to Kalmbach in a Washington hotel room. [Reeves, 2001, pp. 309]

The New York Times publishes the first of the so-called “Pentagon Papers,” the Defense Department’s secret history of the Vietnam War during the Kennedy and Johnson administrations (see January 15, 1969 and March 1971). The Washington Post will begin publishing the papers days later. [Reeves, 2001, pp. 330; Moran, 2007] The first story is entitled “Vietnam Archive: Pentagon Study Traces Three Decades of Growing US Involvement,” and is labeled the first of a series. [Moran, 2007] The opening paragraph, by reporter Neil Sheehan, reads, “A massive study of how the United States went to war in Indochina, conducted by the Pentagon three years ago, demonstrates that four administrations [Eisenhower, Kennedy, Johnson, and Nixon] progressively developed a sense of commitment to a non-Communist Vietnam, a readiness to fight the North to protect the South, and an ultimate frustration with this effort—to a much greater extent than their public statements acknowledged at the time.” [Reeves, 2001, pp. 330]

[Werth, 2006, pp. 84-87] In a tape-recorded conversation the same day as the first story is published, Nixon tells National Security Adviser Henry Kissinger that in some ways, the story helps him politically, serving to remind the voting public that the Vietnam War is more the product of his predecessors’ errors than his own. Nixon says that the publication just proves how important it is for his administration to “clean house” of disloyal members who might take part in such a “treasonable” act. [Moran, 2007] “This is really tough on Kennedy, [Robert] McNamara [Kennedy’s secretary of defense], and Johnson,” he says. “Make sure we call them the Kennedy-Johnson papers. But we need… to keep out of it.” [Reeves, 2001, pp. 331]
Kissinger Argues that Leak is a Threat to Nixon's Administration - However, Kissinger is furious, yelling to his staff: “This will destroy American credibility forever. We might as well just tell it all to the Soviets and get it over with.” Kissinger convinces Nixon to try to stop the Times from publishing the documents by in part appealing to his masculinity—Nixon would not want to appear as a “weakling” to his foreign adversaries, Kissinger argues. Kissinger himself fears that his former association with Ellsberg will damage his own standing in the White House. Kissinger says he knows that Ellsberg is a womanizer and a “known drug user” who “shot at peasants in Vietnam,” and that information can be used to damage Ellsberg’s credibility (see Late June-July 1971). [Reeves, 2001, pp. 334; Werth, 2006, pp. 84-87] One of the arguments Kissinger successfully uses to stoke Nixon’s ire is that the papers were leaked by one or more “radical left-wing[ers]” to damage the administration’s credibility. Nixon calls the leak a “conspiracy” against him and his administration. [Moran, 2007] Nixon soon attempts to stop further publications with a lawsuit against the Times (see June 15, 1971). The Post will also become involved in the lawsuit. [Herda, 1994] Nixon initially believes former Kissinger aide Leslie Gelb, now of the Brookings Institute, is responsible for leaking the documents. Although Nixon does not know this, he is quite wrong. Gelb has always worried that the documents would cause tremendous controversy if ever made public. Only 15 copies exist: five in Secretary of Defense Melvin Laird’s safe; copies under lock and key at the Kennedy and Johnson presidential libraries; several copies in the hands of former Johnson administration officials, including McNamara and his successor, Clark Clifford; and two at the RAND Corporation. Nixon widens his speculation over the leak, telling his chief of staff H. R. Haldeman that someone on Kissinger’s staff may have leaked the documents, or maybe some unknown group of “f_cking Jews.” Regardless of who it is, Nixon says, “Somebody’s got to go to jail for that.” It is Kissinger who quickly figures that Ellsberg was the leaker. Donald Segretti.Donald Segretti. [Source: Spartacus Educational]Three attorneys—one the assistant attorney general of Tennessee, Alex Shipley—are asked to work as so-called “agent provocateur” for the Campaign to Re-elect the President (CREEP), an organization working to re-elect President Nixon (see October 10, 1972). The three tell their story to Washington Post reporter Carl Bernstein in late September 1972, and Bernstein’s colleague Bob Woodward learns more from his FBI source, “Deep Throat,” days later (see October 7, 1972 and October 9, 1972). They all say they were asked to work to undermine the primary campaigns of Democratic presidential candidates by the same man, Donald Segretti, a former Treasury Department lawyer who lives in California. Segretti will later be identified as a CREEP official. Segretti, the attorneys will say, promises them “big jobs” in Washington after Nixon’s re-election (see November 7, 1972). All three says they rejected Segretti’s offers (see June 27-October 23, 1971). Segretti himself will deny the allegations, calling them “ridiculous.”
Part of a Larger Pattern? - Bernstein and Woodward connect the Segretti story to other Nixon campaign “dirty tricks” they are already aware of, including efforts by Watergate burglar James McCord (see June 19, 1972) to “investigate” reporter Jack Anderson, attempts by Watergate surveillance man Alfred Baldwin (see June 17, 1972) to infiltrate Vietnam Veterans Against the War, Watergate burglar E. Howard Hunt’s successful attempts to electronically “bug” Democratic campaign headquarters (see May 27-28, 1972) and his investigation of Democratic presidential candidate Edward Kennedy (see June 19, 1972), and McCord’s rental of an office next to the offices of Democratic presidential candidate Edmund Muskie. To the reporters, the Segretti story opens up speculation that the Nixon campaign had undertaken political espionage efforts long before the Watergate burglary. In their book All the President’s Men, Bernstein and Woodward write, “Watergate could have been scheduled before the president’s re-election chances looked so good and perhaps someone had neglected to pull the plug.” Bernstein has heard of CIA operations such as this mounted against foreign governments, called “black operations,” but sometimes more colloquially called “mindf_cking.” [Bernstein and Woodward, 1974, pp. 114-115]
Segretti a 'Small Fish in a Big Pond' - An FBI official investigating CREEP’s illegal activities will call Segretti “a small fish in a big pond,” and will say that at least 50 undercover Nixon operatives have worked around the country to disrupt and spy on Democratic campaigns. The political intelligence and sabotage operation is called the “offensive security” program both by White House and CREEP officials. FBI investigators will find that many of the acts of political espionage and sabotage conducted by Segretti and his colleagues are traced to this “offensive security” program, which was conceived and directed in the White House and by senior CREEP officials, and funded by the secret “slush fund” directed by CREEP finance manager Maurice Stans (see September 29, 1972). FBI officials will refuse to directly discuss Segretti’s actions, saying that he is part of the Watergate investigation (see 2:30 a.m.June 17, 1972), but one FBI official angrily calls Segretti’s actions “indescribable.”
White House Connections Confirmed - In mid-October 1972, the Washington Post will identify Dwight Chapin, President Nixon’s appointments secretary, as the person who hired Segretti and received reports of his campaign activities. Segretti’s other contact is Hunt. Segretti also received at least $35,000 in pay for his activities by Nixon’s personal lawyer, Herbert Kalmbach. [Washington Post, 1/31/1973]

As another assignment for the newly formed “Plumbers” (see Late June-July 1971), President Nixon orders chief of staff H. R. Haldeman to have the Brookings Institute burglarized (see June 17, 1972). The Brookings Institute is a Washington think tank which Nixon believes has copies of the Pentagon Papers. As secretly recorded, Nixon tells Haldeman: “I want the break-in. Hell, they do that” [presumably referring to the Democrats]. “They have a lot of material. I want—the way I want that handled, Bob, is get it over. I want Brooking. Just break in. Break in and take it out. You understand.” Haldeman replies: “Yeah. But you have to get somebody to do it.” Nixon says: “Well, you—that’s what I’m just telling you. Now don’t discuss it here. You’re to break into the place, rifle the files, and bring them out.” Haldeman is untroubled by the order: “I don’t have any problem with breaking in.” Nixon is direct in his orders for the burglary: “Just go in and take them. Go in around 8 or 9 o’clock. That’s right. You go in and inspect and clean it out.… We’re up against an enemy, a conspiracy. They’re using any means. We are going to use any means. Is that clear?” The next day, Nixon repeats: “Get it done. I want it done. I want the Brookings Institute’s safe cleaned out.” [PBS, 1/2/1997; Reeves, 2001, pp. 339; Werth, 2006, pp. 84-87]
"Talk to Hunt" - When asked who will do it, Nixon replies: “That’s what I’m talking about. Don’t discuss it here. You talk to Hunt.” Nixon is referring to E. Howard Hunt, a recently retired CIA officer currently performing secret operations for Nixon’s aide Charles Colson. Haldeman says approvingly that CIA director Richard Helms “says he’s ruthless, quiet, careful. He’s kind of a tiger.… He spent 20 years in the CIA overthrowing governments.” [Reeves, 2001, pp. 339]
"Black-Bag" Team Assembled - Ehrlichman’s deputies Egil “Bud” Krogh and David Young, whom he has put in charge of the operation, soon report that they’ve assembled a “black-bag” team and have recommended a “covert operation” to burglarize an office at the Institute. (Krogh sums up Nixon’s thinking quite eloquently: “Anyone who opposes us, we’ll destroy. As a matter of fact, anyone who doesn’t support us, we’ll destroy.”) Ehrlichman approves the project, noting it must not be “traceable.” The same team of burglars who rifle the office will later be used to break into the Democratic headquarters at the Watergate Hotel (see 2:30 a.m.June 17, 1972). Newspaper Editor Targeted for Burglary - Another project, which also apparently never takes place, involves stealing documents from the safe of the editor of the Las Vegas Sun, Hank Greenspun. “Plumbers” burglar James McCord will later explain that Greenspun is a target because of his relationship with eccentric billionaire Howard Hughes and former Hughes associate Robert Maheu, and that Maheu has damaging information on a Democratic presidential candidate, Edmund Muskie, that the Nixon aides want. However, author Carl Oglesby will later claim that the material refers to Nixon and not to Muskie. [Spartacus Schoolnet, 8/2007; Spartacus Schoolnet, 8/2007] In 2001, historian Richard Reeves writes that the files contain information about Nixon and Democratic National Committee chairman Lawrence O’Brien. Nixon’s close friend and political financier Charles “Bebe” Rebozo had just gotten $50,000 in campaign cash from Hughes, and O’Brien is earning $13,000 a month lobbying for one of Hughes’s corporations. Call Girl Operation Turned Down - Another “Plumber,” G. Gordon Liddy, suggests using a coterie of Washington, DC call girls to infiltrate the Democratic campaign organization and bring out information, a suggestion that is not seriously considered. [Spartacus Schoolnet, 8/2007]
Inappropriate Conversation? - During the discussion, White House counsel John Dean interrupts to say, “Excuse me for saying this, but I don’t think this kind of conversation should go on in the attorney general’s office.” They are meeting in the office of Attorney General John Mitchell. Nixon aide John Ehrlichman reports that he has successfully created the special investigations unit ordered by the president (see Late June-July 1971). His first choice to head the unit, speechwriter Pat Buchanan, refused the position. Ehrlichman rejected fellow aide Charles Colson’s own choice, retired CIA agent E. Howard Hunt, who has recently joined the White House staff (see July 7, 1971). Ehrlichman turned to his own protege, Egil “Bud” Krogh, and David Young, a former assistant to National Security Adviser Henry Kissinger, to head the unit. Young gives the unit its nickname of “Plumbers” after he hangs a sign on his office door reading, “D. YOUNG—PLUMBER.” Their first hire is former FBI agent and county prosecutor G. You know, the big Jewish contributors to the Democrats. Could you please investigate some of the [expletive deleted].” The next day, Nixon continues the conversation, asking his chief of staff, H. R. Haldeman: “What about the rich Jews? Eugenio Martinez.Eugenio Martinez. [Source: public domain]President Nixon’s “Plumbers” unit, tasked to plug media leaks from administration officials and outsiders to the media, burglarizes the Los Angeles office of psychiatrist Lewis Fielding to find damaging information on Daniel Ellsberg, the former defense analyst and patient of Fielding who leaked the “Pentagon Papers” to the media. [Gerald R. Ford Library and Museum, 7/3/2007] Ellsberg is a former Marine captain in Vietnam and protege of Henry Kissinger who had a change of heart over the war; he then leaked a secret set of Pentagon documents to the New York Times detailing how the Kennedy and Johnson administrations had secretly escalated the war in Vietnam (see June 13, 1971).
Watergate Connection - One of the burglars is Eugenio Martinez, who later is arrested as one of the five Watergate burglars (see 2:30 a.m.June 17, 1972). Martinez and two others—Felipe de Diego and the mission leader, E. Howard Hunt, who will supervise the Watergate burglary—are all old “CIA hands” heavily involved in anti-Castro activities. Martinez is still active in the CIA, as is Hunt, whom he often refers to by his old CIA code name of “Eduardo.” Another Watergate burglar, CIA agent Bernard Barker, is also involved in the Ellsberg burglary.
Martinez: Burglary a Near-Disaster - Hunt tells Martinez and Diego that they are to burglarize the offices of a “traitor” who is spying for the Soviet Union, and that the mission was ordered by the White House, where Hunt is now an aide. Barker tells the Cubans, “We have to find some papers of a great traitor to the United States, who is a son of a b_tch .” The men will become a unit outside the normal law enforcement and intelligence channels, operating within but not part of the CIA, FBI, and “all the agencies,” Martinez will later recall. They buy photographic equipment at Sears, and Hunt and Diego use disguises—wigs, fake glasses, false identification, and voice-altering devices. “Barker recognized the name on Hunt’s false identification—Edward J. Hamilton—as the same cover name Eduardo had used during the Bay of Pigs,” Martinez will recall. The planning, Martinez will recall, is far looser and less meticulous than “anything I was used to in the [CIA].” A disguised Hunt and Diego, masquerading as delivery men, deliver the photographic equipment to the office; later that night, they and Martinez break in and rifle the office. Martinez will write that Hunt and de Diego looked “kind of queerish” in their disguises, with their “Peter Lorre-type glasses, and the funny Dita Beard wigs” (see February 22, 1972). Before the break-in, Barker, who does not enter, whispers to Martinez, “Hey, remember this name—Ellsberg.” Martinez does not recognize the name. [Harper's, 10/1974; Reeves, 2001, pp. 369]
Comedy of Errors - The burglars wait for hours until the cleaning lady leaves for the night, and find the door to the building locked. At that point, a fifth man, “George,” whom Martinez learns is G. Gordon Liddy, another of the Watergate burglars also involved in the Ellsberg planning, appears and tells them to break in through a window. [Harper's, 10/1974] Three burglars—Bernard Barker, Felipe de Diego, and Eugenio Martinez—perform the actual break-in, while Hunt and Liddy act as lookouts. [Reeves, 2001, pp. 369] The burglary is quickly turning into a comedy of errors, Martinez will recall. “This was nothing new. It’s what the Company did in the Bay of Pigs when they gave us old ships, old planes, old weapons. They explained that if you were caught in one of those operations with commercial weapons that you could buy anywhere, you could be said to be on your own. They teach you that they are going to disavow you. The Company teaches you to accept those things as the efficient way to work. And we were grateful. Otherwise we wouldn’t have had any help at all. In this operation it seemed obvious—they didn’t want it to be traced back to the White House. Eduardo told us that if we were caught, we should say we were addicts looking for drugs.” Martinez finds nothing concerning Ellsberg in the office except for Fielding’s telephone book, which Martinez photographs. Before leaving, Martinez spills some pills from Fielding’s briefcase—“vitamin C, I think”—over the floor to make it seem as if the burglars had broken in looking for drugs. As they leave the office, Martinez spots a police car trailing them, but they are not stopped. “I thought to myself that the police car was protecting us. That is the feeling you have when you are doing operations for the government. You think that every step has been taken to protect you.”
Failure; Training for Bigger Mission? - Martinez feels that the burglary is a failure, but Hunt insists that they celebrate anyway. Martinez tells Diego that the break-in must either be a training exercise for a more important mission to come, or it was a cover operation for something else. “I thought to myself that maybe these people already had the papers of Ellsberg. Maybe Dr. Fielding had given them out and for ethical reasons he needed to be covered. It seemed that these people already had what we were looking for because no one invites you to have champagne and is happy when you fail,” he will write. Martinez’s CIA supervisor is strangely uninterested in the incident. “I was certain then that the Company knew about his activities,” Martinez will write. “But once again my CO did not pursue the subject.” [Harper's, 10/1974] Hunt telephones Plumbers supervisor Egil Krogh at 4 a.m. to report that the burglary was a success but they found no files on Ellsberg. Gordon Liddy lays out an elaborate $1 million proposal for a plan for political espionage and campaign “dirty tricks” he calls “Operation Gemstone” to Attorney General John Mitchell. Mitchell is preparing to leave his post to head the Committee to Re-elect the President (CREEP—see March 1, 1972). “Gemstone” is a response to pressure from President Nixon to compile intelligence on Democratic candidates and party officials, particularly Democratic National Committee chairman Lawrence O’Brien. Liddy gives his presentation with one hand bandaged—he had recently charred it in a candle flame to demonstrate the pain he was willing to endure in the name of will and loyalty. Sub-operations such as “Diamond,” “Ruby,” and “Sapphire” engender the following, among other proposed activities:
bullet disrupt antiwar demonstrators before television and press cameras can arrive on the scene, using “men who have worked successfully as street-fighting squads for the CIA” [Reeves, 2001, pp. 429-430] or what White House counsel John Dean, also at the meeting, will later testify to be “mugging squads;” [Time, 7/9/1973]
bullet kidnap, or “surgically relocate,” prominent antiwar and civil rights leaders by “drug[ging” them and taking them “across the border;”
bullet use a pleasure yacht as a floating brothel to entice Democrats and other undesirables into compromising positions, where they can be tape-recorded and photographed with what Liddy calls “the finest call girls in the country… not dumb broads but girls who can be trained and photographed;”
bullet deploy an array of electronic and physical surveillance, including chase planes to intercept messages from airplanes carrying prominent Democrats. [Reeves, 2001, pp. 429-430]
Dean, as he later testifies, is horrified at the ideas. [Time, 7/9/1973] Mitchell seems more amused than anything else at Liddy’s excesses, he merely says that “Gemstone” is “not quite what I had in mind.” He tells Liddy and Liddy’s boss, CREEP deputy director Jeb Stuart Magruder, to come back with a cheaper and more realistic proposal. The massive Federal Election Campaign Act (FECA) is signed into law by President Nixon. (The law is commonly thought of in the context of 1971, when Congress passed it, but Nixon did not sign it into law for several months.) The law is sparked by a rising tide of anger among the public, frustrated by the Vietnam War and the variety of movements agitating for change. The campaign watchdog organization Common Cause sued both the Democratic and Republican National Committees for violating the Federal Corrupt Practices Act (FCPA—see 1925), and though it lost the suit, it exposed the flaws and limitations of the law to the public. Common Cause then led a push to improve campaign finance legislation, aided by the many newly elected and reform-minded members of Congress. FECA repeals the toothless FCPA and creates a comprehensive framework for the regulation of federal campaign financing, from primaries and runoffs to conventions and general elections. The law requires full and timely disclosure of donations and expenditures, and provides broad definitions of both. It sets limits on media advertising as well as on contributions from candidates and their family members. The law permits unions and corporations to solicit voluntary contributions from members, employees, and stockholders, and allows union and corporate treasury money to be used for operating expenses for political action committees (PACs) or for voter drives and the like. It bans patronage or the promise of patronage, and bans contracts between a candidate and any federal department or agency. It establishes strict caps on the amounts individuals can contribute to their own campaigns—$50,000 for presidential and vice-presidential candidates, $35,000 for Senate candidates, and $25,000 for House candidates. It establishes a cap on television advertising at 10 cents per voter in the last election, or $50,000, whichever is higher. President Nixon’s personal lawyer, Herbert Kalmbach, delivers over $900,000 in secret campaign contributions to the Committee to Re-elect the President (CREEP). He has collected the money on Nixon’s orders, passing along Nixon’s instructions to donors, one of which is “Anybody who wants to be an ambassador must give at least $250,000.” In total, CREEP collects nearly $20 million, $2 million in cash. CREEP reports none of this money—and because the new campaign finance laws do not go into effect until April 7, the organization is not legally bound to declare it until that time. Some of the contributors are executives and corporations in trouble with the IRS or the Justice Department. Some are Democrats openly contributing to Democratic candidates and hedging their bets with contributions to Nixon and other Republicans. Much of the money is “laundered” through Mexican and Venezuelan banks. “Plumber” G. Gordon Liddy moves $114,000 through fellow “Plumber” Bernard Barker’s Miami bank accounts (see April-June 1972 and June 21, 1972). More money resides in safety deposit boxes in New York, Los Angeles, Washington, and Miami. “Plumber” E. According to later testimony to Watergate investigators, the deputy director of the Committee to Re-elect the President (CREEP), Jeb Magruder, delivers the logs of the wiretaps being secretly conducted on the Democrats by the “Plumbers” (see May 27-28, 1972 and May 29, 1972) to CREEP chairman John Mitchell. The wiretaps are code-named “Gemstone” (see September 29, 1972). Magruder also delivers photos taken inside the Democrats’ headquarters to Mitchell. While the police are arresting the five Watergate burglars (see 2:30 a.m.June 17, 1972), the team leader, E. Howard Hunt, goes to the hotel room in which Nixon campaign aide Alfred Baldwin has been monitoring the electronic surveillance devices surreptitiously installed in Democratic National Committee headquarters (see May 27-28, 1972). Baldwin was to monitor the burglars and warn them of trouble, but the burglar with the walkie-talkie, Bernard Barker, had his unit turned off and Baldwin was unable to warn them of police arriving on the scene. From Baldwin’s hotel room, Hunt phones a lawyer, Douglas Caddy; Hunt and Caddy both work at a public relations firm, Mullen Company, which some believe is a CIA front organization. Baldwin can hear Hunt talking about money, bail, and posting bonds. Hunt instructs Baldwin to load a van belonging to burglar James McCord with the listening post equipment and sensitive operational documents (the “Gemstone” file—see September 29, 1972), and drive to McCord’s house in Rockville, Maryland. Baldwin will soon tell his story to a lawyer, Robert Mirto; the information will soon find its way to DNC chairman Lawrence O’Brien. This is how O’Brien so quickly learns that White House aides such as Hunt and G. Gordon Liddy were involved in the Watergate burglary (see June 20, 1972). [Spartacus Schoolnet, 8/2007]
FBI Finds Information Connecting Burglars to White House Aide - Within hours of the burglary, FBI agents searching the Watergate hotel rooms of the burglars find a check with the name “E. Howard Hunt” imprinted on it. [O.T. Jacobson, 7/5/1974 pdf file] In October 1974, burglar Bernard Barker will write: “When we went on the mission, I had put all our identifications and wallets in a bag in the hotel room, and I told Howard that if something happened he would have everything, including my address book with the White House phone number. But when he left the room, he was in such a big hurry that he left everything there. This was a very bad mistake, of course, because [the FBI] immediately established the connection with Hunt and me. They had the connections on a silver platter. But I guess Hunt had enough things to worry about then.” [Harper's, 10/1974] The agents, quickly learning that Hunt is a White House employee, interview Hunt at his Potomac home; Hunt admits the check is his, but denies any knowledge of the burglary. Discovery - They are surprised at gunpoint by three plainclothes officers of the DC Metropolitan Police. Two ceiling panels have been removed from the secretary’s office, which is adjacent to that of DNC chairman Lawrence O’Brien. It is possible to place a surveillance device above those panels that could monitor O’Brien’s office. The five suspects, all wearing surgical gloves, have among them two sophisticated voice-activated surveillance devices that can monitor conversations and telephone calls alike; lock-picks, door jimmies, and an assortment of burglary tools; and $2,300 in cash, most of it in $100 bills in sequence. They also have a walkie-talkie, a shortwave receiver tuned to the police band, 40 rolls of unexposed film, two 35mm cameras, and three pen-sized tear gas guns. Near to where the men are captured is a file cabinet with two open drawers; a DNC source speculates that the men might have been preparing to photograph the contents of the file drawers.
Guard Noticed Taped Door - The arrests take place after a Watergate security guard, Frank Wills, notices a door connecting a stairwell with the hotel’s basement garage has been taped so it will not lock; the guard removes the tape, but when he checks ten minutes later and finds the lock taped once again, the guard calls the police. The police find that all of the stairwell doors leading from the basement to the sixth floor have been similarly taped to prevent them from locking. The door leading from the stairwell to the DNC offices had been jimmied. During a search of the offices, one of the burglars leaps from behind a desk and surrenders. [Washington Post, 6/18/1972] The FBI agents responding to the burglary are initially told that the burglars may have been attempting to plant a bomb in the offices. The “bomb” turns out to be surveillance equipment. [O.T. Jacobson, 7/5/1974 pdf file]
Last Mission for Martinez - One of the burglars, Cuban emigre and CIA agent Eugenio Martinez, will recall the burglary. They have already successfully burglarized a psychiatrist’s office in search of incriminating material on Pentagon Papers leaker Daniel Ellsberg (see September 9, 1971), and successfully bugged the DNC offices less than a month previously (see May 27-28, 1972), but Martinez is increasingly ill at ease over the poor planning and amateurish behavior of his colleagues (see Mid-June 1972). This will be his last operation, he has decided. Team leader E. Howard Hunt, whom Martinez calls by his old code name “Eduardo,” is obviously intrigued by the material secured from the previous burglary, and wants to go through the offices a second time to find more. Martinez is dismayed to find that Hunt has two operations planned for the evening, one for the DNC and one for the campaign offices of Democratic candidate George McGovern. Former CIA agent and current Nixon campaign security official James McCord (see June 19, 1972), the electronics expert of the team, is equally uncomfortable with the rushed, almost impromptu plan. Hunt takes all of the burglars’ identification and puts it in a briefcase. He gives another burglar, Frank Sturgis, his phony “Edward J. Hamilton” ID from his CIA days, and gives each burglar $200 in cash to bribe their way out of trouble. Interestingly, Hunt tells the burglars to keep the keys to their hotel rooms. Martinez later writes: “I don’t know why. Even today, I don’t know. Remember, I was told in advance not to ask about those things.”
Taping the Doors - McCord goes into the Watergage office complex, signs in, and begins taping the doors to the stairwells from the eighth floor all the way to the garage. After waiting for everyone to leave the offices, the team prepares to enter. Gonzalez and Sturgis note that the tape to the basement garage has been removed. Martinez believes the operation will be aborted, but McCord disagrees; he convinces Hunt and the other team leader, White House aide G. Gordon Liddy, to continue. It is McCord’s responsibility to remove the tape once the burglars are inside, but he fails to do so. The team is well into the DNC offices when the police burst in. “There was no way out,” Martinez will recall. “We were caught.” Barker is able to surreptitiously advise Hunt, who is still in the hotel, that they have been discovered. Martinez will later wonder if the entire second burglary might have been “a set-up or something like that because it was so easy the first time. We all had that feeling.” The police quickly find the burglars’ hotel keys and then the briefcase containing their identification. As they are being arrested, McCord, who rarely speaks and then not above a whisper, takes charge of the situation. He orders everyone to keep their mouths shut. “Don’t give your names,” he warns. “Nothing. I know people. Don’t worry, someone will come and everything will be all right. 'Third-Rate Burglary' - White House press secretary Ron Ziegler will respond to allegations that the White House and the Nixon presidential campaign might have been involved in the Watergate burglary by calling it a “third-rate burglary attempt,” and warning that “certain elements may try to stretch this beyond what it is.” [Washington Post, 5/1/1973] The Washington Post chooses, for the moment, to cover it as a local burglary and nothing more; managing editor Howard Simons says that it could be nothing more than a crime committed by “crazy Cubans.” [Bernstein and Woodward, 1974, pp. 19]
CIA Operation? - In the weeks and months to come, speculation will arise as to the role of the CIA in the burglary. The Nixon White House will attempt to pin the blame for the Watergate conspiracy on the CIA, an attempt forestalled by McCord (see March 19-23, 1973). In a 1974 book on his involvement in the conspiracy, McCord will write: “The Watergate operation was not a CIA operation. The Cubans may have been misled by others into believing that it was a CIA operation. I know for a fact that it was not.” Another author, Carl Oglesby, will claim otherwise, saying that the burglary is a CIA plot against Nixon. Former CIA officer Miles Copeland will claim that McCord led the burglars into a trap. Journalist Andrew St. George will claim that CIA Director Richard Helms knew of the break-in before it occurred, a viewpoint supported by Martha Mitchell, the wife of Nixon campaign director John Mitchell, who will tell St. George that McCord is a “double agent” whose deliberate blunders led to the arrest of the burglars. No solid evidence of CIA involvement in the Watergate conspiracy has so far been revealed. [Spartacus Schoolnet, 8/2007]

In an early-morning meeting between Nixon campaign director John Mitchell and White House aides H. R. Haldeman and John Ehrlichman, the three agree that their first priority in the aftermath of the Watergate burglary (see 2:30 a.m.June 17, 1972) is to protect President Nixon. To that end, the Watergate investigations must be stopped before they lead to other unsavory political operations—campaign “horrors,” Mitchell calls them.
PR 'Counter-Attack' Discussed - Later this morning, Nixon and Haldeman discuss the need to keep the FBI’s Watergate investigation on a tight leash. They discuss “counter-attack” and “public relations” offensives to distract the media by attacking the Democrats. The White House needs a “PR offensive to top” Watergate, they say, and they “need to be on the attack—for diversion.” One suggestion is to dismiss the burglary as nothing but a prank. Most White House staffers, including Haldeman, seem to believe that fellow aide Charles Colson concocted the idea of the burglary; Haldeman says that Colson does not seem to know “specifically that this was underway. He seems to take all the blame himself.” Nixon replies, “Good.” Nixon worries that his secret taping system (see February 1971 and July 13-16, 1973) “complicates things all over.” Nixon closes the conversation by saying: “My God, the [Democratic National C]ommittee isn’t worth bugging, in my opinion. Nixon, Colson Plan Delays - Later the same day, Nixon meets with senior aide Charles Colson. Several items from the conversation are damning in their specificity. Nixon tells Colson in regard of the Watergate burglary (see 2:30 a.m.June 17, 1972), “If we didn’t know better, we would have thought it was deliberately botched.” This statement shows that Nixon has some detailed knowledge of the burglary, contrary to his later claims. Colson later says: “Bob [Haldeman] is pulling it all together. Thus far, I think we’ve done the right things.” Colson could well be referring to the White House’s attempts to distance itself from the break-in. Nixon says, referring to the burglars, “Basically, they are pretty hard-line guys,” and Colson interrupts, “You mean Hunt?” referring to the burglars’ leader, E. Howard Hunt. Nixon replies: “Of course, we are just going to leave this where it is, with the Cubans.… At time, uh, I just stonewall it.” Nixon then says, regarding the future of the Watergate investigation: “Oh sure, you know who the hell is going to keep it alive. We’re gonna have a court case and indeed… the difficulty we’ll have ahead, we have got to have lawyers smart enough to have our people delay, avoiding depositions, of course.” [Reston, 2007, pp. 46-47]

In the case of Pipefitters Local Union No. 562 et al v. US, the Supreme Court overturns a criminal conviction of the Pipefitters Union for violating the Smith-Connally Act (see June 25, 1943) and the Federal Corrupt Practices Act (FCPA—see 1925). That law bans labor unions from contributing to political campaigns, and Pipefitters Union officials had administered a political action committee (see 1944). The Court, citing the newly passed Federal Election Campaign Act (FECA—see February 7, 1972), overturns the conviction, ruling that FECA “plainly permits union officials to establish, administer, and solicit contributions for a political fund.” The decision is later codified by the amendments to the law (see 1974). Washington Post reporters Bob Woodward and Carl Bernstein are discussing their upcoming story documenting the secret Nixon campaign “slush fund” controlled by former Attorney General John Mitchell (see Early 1970 and September 29, 1972) when Bernstein has an epiphany of sorts—a “literal chill going down my neck,” he will recall in 2005. “Oh my God,” he tells Woodward. “The president is going to be impeached.” After a moment, Woodward replies, “Jesus, I think you’re right.” Woodward then says, “We can never use that word in this newsroom.” No one in Congress has broached the subject of impeachment yet, and will not for another year, but neither journalist wants anyone to think that they might have some sort of agenda in their reporting. “Any suggestion about the future of the Nixon presidency could undermine our work and the Post’s efforts to be fair,” Bernstein will later write. The two will later decide not to include this anecdote in their book All the President’s Men (see June 15, 1974), as it would be published during the House Judiciary Committee’s impeachment investigation of President Nixon (see February 6, 1974). “To recount it then might have given the impression that impeachment had been our goal all along,” Bernstein will write. “It was not. Hugh Sloan.Hugh Sloan. [Source: Washington Post]The former treasurer for the Campaign to Re-elect the President (CREEP), Hugh Sloan, tells Washington Post reporter Carl Bernstein that the situation with CREEP’s finances is far worse than the Post has reported (see September 14-17, 1972). “That’s why I left, because I suspected the worst,” he says. He refuses to give specifics, citing the continuing FBI investigation and his lawyer’s advice to remain silent. He does confirm that CREEP officials had instructed employees to be evasive when interviewed by the FBI (see August, 1972), and that the committee’s handling of the FBI investigation was managed by CREEP officials Robert Mardian and Frederick LaRue. He also confirms that former CREEP director John Mitchell knew of the illegal campaign “slush fund” (see September 29, 1972). “Mitchell had to know of the funds,” Sloan says. “You don’t just give out that kind of money without the head of the campaign knowing what it’s going for, especially when his people are getting the cash.” Mitchell, LaRue, and Mardian are the three directly responsible for managing the fund, Sloan believes, and are responsible for ordering the destruction of financial records after the Watergate burglary (see 2:30 a.m.June 17, 1972). The previously reported “convention security” fund (see July 7, 1972) and the campaign “slush fund” are one and the same, Sloan confirms. Sloan acknowledges making payouts from the fund, but will not reveal who authorized him to do so. Perhaps most interestingly, Sloan says that the general perception of the Nixon administration and CREEP as two separate, self-contained entities is wrong, that everything CREEP does is managed by senior White House officials. Coming away from the meeting, Bernstein and his colleague Bob Woodward are now sure that the Watergate conspiracy does not end in CREEP, but extends into the White House itself. [Source: Southern Methodist University]The Washington Post reports that John Mitchell, the former attorney general and former head of the Committee to Re-elect the President (CREEP), personally controlled a secret Republican “slush fund” used to finance widespread intelligence-gathering operations against the Democratic Party (see Early 1970). [Gerald R. Ford Library and Museum, 7/3/2007] Mitchell had authorized expenditures from the fund beginning in the spring of 1971, while he was attorney general. [Bernstein and Woodward, 1974, pp. 98-103] The fund was originally conceived by White House aide G. Gordon Liddy, who in 1972 came up with what he called “Operation Gemstone,” a $1 million plan to carry out a series of covert and often illegal actions against President Nixon’s political enemies (see January 29, 1972). Mitchell scaled back the budget to $250,000 (at first) to launch a scaled-down version of Gemstone. [Spartacus Schoolnet, 8/2007] Mitchell personally approved a number of withdrawals from the fund, which swelled in size from around $350,000 to $700,000 at any given time. Four others besides Mitchell were later authorized to approve payments from the secret fund. One is Maurice Stans, the former commerce secretary who is now finance chairman of CREEP; the fund was kept in a safe in Stans’s office. A second is Jeb Magruder, the former manager of CREEP who is now deputy director of the organization. A third is a senior White House official involved in the campaign, and the other is a campaign aide based outside of Washington. Haldeman, but they cannot get anyone to go on record to confirm their assumption, and therefore do not print Haldeman’s name in the story.) [Bernstein and Woodward, 1974, pp. 100]
Mitchell's Explosive Reaction - Mitchell is outraged by the allegations. When Bernstein calls to confirm the story, he explodes: “Jesus!… All that crap, you’re putting it in the paper? It’s all been denied. Katie Graham [Katherine Graham, publisher of the Post] is gonna get caught in a big fat wringer if that’s published. Good Christ! That’s the most sickening thing I’ve ever heard.” (The actual quote, which Post executive editor Ben Bradlee cleans up for public consumption, is, “Katie Graham’s gonna get her t_t caught in a big fat wringer if that’s published.”) [Washington Post, 9/29/1972; Bernstein and Woodward, 1974, pp. 105; Woodward, 2005, pp. 72] Mitchell continues: “You fellows got a great ball game going. As soon as you’re through paying Williams [Edward Bennett Williams, whose law firm represents the Democratic Party, as well as the Post], we’re going to do a story on all of you.” When Bradlee hears of Mitchell’s reaction, he asks if Mitchell was drunk. When Bernstein replies that he doesn’t believe so, and Bradlee confirms that Bernstein properly identified himself as a reporter, Bradlee tells Bernstein to print Mitchell’s reaction. CREEP spokesman Powell Moore tries to persuade Bradlee not to run the Mitchell quote, saying that it wasn’t fair to run the quote because Bernstein woke Mitchell up, and therefore Mitchell’s “composure [was] not guarded.” Bradlee refuses to delete the quote. CREEP Denials - Moore later states that neither Mitchell or Stans knows anything about “any disbursement from an alleged fund as described by the Post and neither of them controlled any committee expenditures while serving as government officials.” One of the planners of the Watergate burglary (see 2:30 a.m.June 17, 1972), G. Gordon Liddy, withdrew well over $50,000 from the fund. Although records of the fund’s disbursements have been destroyed, other sources indicate that some of the other recipients of the fund include Magruder; Herbert L. “Bart” Porter, CREEP’s scheduling director; several White House officials; and other unidentified persons not officially part of either CREEP or the Nixon administration. Magruder denies ever receiving any such funds. The General Accounting Office has said that such a fund is a “possible and apparent” violation of a new, stricter campaign finance disclosure law. While researching the story that would reveal the extensive “dirty tricks” operations conducted by the Nixon presidential campaign (see June 27, 1971, and Beyond), Washington Post reporter Carl Bernstein learns of the extensive connections between “agent provocateur” Donald Segretti and members of the Nixon administration.
College Connection - Segretti, Nixon press secretary Ron Ziegler, White House appointments secretary Dwight Chapin, and Ziegler’s aide Tim Elbourne had all attended college together at the University of Southern California. All were members of a campus political group called “Trojans for Representative Government.” The group carried out a number of dirty campus political operations, which they called “ratf_cking.” Some of their “tricks” included ballot box stuffing, planting of spies in opposition camps, and spreading of bogus campaign literature designed to drive students away from the targeted candidate.
Campaigns - Ziegler and Chapin had joined Richard Nixon’s gubernatorial campaign in 1962, which was managed by H. R. Haldeman, now Nixon’s closest White House aide. After Nixon lost that election, Ziegler, Chapin, and Elbourne had worked for Haldeman in an advertising agency. Ziegler and Chapin had recruited Segretti and Elbourne to take part in the 1972 Nixon campaign.
Confirmation - A Justice Department official confirms that Segretti is under investigation for political sabotage and espionage operations, and says that he is familiar with the term “ratf_cking.” Bernstein discusses Segretti with a Justice Department attorney, who is outraged at the entire idea. “Ratf_cking?” he snarls. “You can go right to the top with that one. I was shocked when I heard it. I couldn’t believe it. These are public servants? God. It’s nauseating. You’re talking about fellows who come from the best schools in the country. Men who run the government!” The attorney calls the Segretti operation “despicable,” and Segretti himself “indescribable.” “You’re dealing with people who act like this is Dodge City, not the capital of the United States.” The attorney hints that the Nixon campaign “slush fund” (see September 29, 1972) helped pay for the operations, and that the “Canuck letter” (see February 24-25, 1972) was one of the Nixon campaign’s operations.
Mitchell Involved - Bernstein prods the attorney about the phrase “go right to the top,” and mentions former campaign manager John Mitchell. The attorney says of Mitchell: “He can’t say he didn’t know about it, because it was strategy—basic strategy that goes all the way to the top. Higher than him, even.” Woodward is stunned. Higher than Mitchell? The only three people in the Nixon administration higher than Mitchell are Nixon’s top aides, H. R. Haldeman and John Ehrlichman, and Richard Nixon himself. Bernstein and colleague Bob Woodward later write, “For the first time, [Bernstein] considered the possibility that the president of the United States was the head ratf_cker.” [Bernstein and Woodward, 1974, pp. 126-129]

Washington Post reporter Bob Woodward is phoned by a Post reporter in Los Angeles, Robert Meyers. Meyers has spoken with a fraternity brother of Nixon campaign operative Donald Segretti (see June 27, 1971, and Beyond). The fraternity brother, Larry Young, told Meyers that the FBI learned of Segretti and his campaign operations through the phone records of Watergate burglar E. Howard Hunt (see 2:30 a.m.June 17, 1972). Hunt had called Segretti numerous times to give Segretti instructions about something Young does not know, but “it wasn’t the [campaign] bugging.” Woodward had not known of any Segretti-Hunt connection. Young told Meyers that Segretti admitted working for “a wealthy California Republican lawyer with national connections and I get paid by a special lawyer’s trust fund.” Woodward believes the lawyer in question is Herbert Kalmbach, President Nixon’s personal lawyer; Meyers had asked Young about Kalmbach, but Young did not recognize the name. He does identify the lawyer as having an office in Newport Beach, where Kalmbach has his office. Young believes that Segretti met with both Hunt and White House aide Dwight Chapin (see October 7, 1972). Segretti often talked of going to Miami—the home of most of the Watergate burglars—to meet with Hunt and Chapin. Segretti told Young that when he was in Miami, someone Segretti didn’t identify asked him to organize a group of young Cubans to mount an assault on the Doral Beach Hotel, the location of the Republican National Convention, and make it look as if the Cubans were McGovern campaign workers. Segretti refused to carry out this particular idea, calling it blatantly illegal and violent. Woodward is aware that just such an assault had indeed taken place at the hotel, and that many suspected that there were Republican provocateurs in the crowd of protesters.
Segretti Worried about Being the Fall Guy - When the FBI first contacted Segretti, two weeks before the July convention, Young says that Segretti was shocked that he had not been given advance warning. Segretti worried that he was being set up as a fall guy. In his testimony to the FBI and before the Watergate grand jury, Segretti told them about his connections with Hunt and Chapin, and named the lawyer who paid him. So, Woodward muses, the Justice Department had known of the connections between Segretti, Hunt, and Chapin since June and had not followed up on them. Young agrees to go on the record as a source, and Woodward confirms the story through a Justice Department lawyer. The FBI didn’t consider what Segretti did to be strictly illegal, the lawyer tells Woodward, but “I’m worried about the case. The Bureau is acting funny… there is interest in the case at the top.… [W]e’re not pursuing it.” The lawyer refuses to be more specific. Chapin carefully denies the story. He admits he and Segretti are old college buddies, and does not directly deny that he was Segretti’s White House contact.
Haldeman Connection - A former Nixon administration official tells Woodward, “If Dwight has anything to do with this, it means Haldeman,” referring to Nixon’s chief of staff H. R. Haldeman. “He does what two people tell him to do: Haldeman and Nixon.” The Post story runs on October 15, without naming Kalmbach. The story breaks two new areas of ground: it is the first of its kind to rely on on-the-record sources (Young), and it is the first to directly allege that the Watergate conspiracy reaches into the White House itself and not merely the Nixon re-election campaign. A Time magazine follow-up adds that Chapin had hired Segretti, and names Gordon Strachan, a political aide to Haldeman, had taken part in hiring Segretti as well. Most importantly, Time names Kalmbach as the lawyer who paid Segretti. Irate at being scooped, Woodward quickly confirms Kalmbach’s status as paymaster with a Justice Department attorney, and in a conversation with former campaign treasurer Hugh Sloan, confirms that Segretti was paid out of the campaign’s “slush fund” managed by campaign finance chief Maurice Stans (see September 29, 1972). Kalmbach had distributed far more money than was given to Segretti, Sloan says. [Bernstein and Woodward, 1974, pp. 150-159]
Verified - On October 18, the New York Times runs a story that uses telephone records to verify Segretti’s calls from Hunt. [Bernstein and Woodward, 1974, pp. 167]

President Nixon meets in his hideaway office in the Executive Office Building with his chief of staff, H. R. Haldeman. Their conversation is captured on Nixon’s secret taping system (see July 13-16, 1973). Haldeman reports that he has learned from his own secret source that there is a leak in the highest echelons of the FBI, a source apparently funnelling information to Washington Post reporters Bob Woodward and Carl Bernstein: “Mark Felt.” Felt, the deputy director of the bureau, is Woodward’s clandestine background source “Deep Throat” (see May 31, 2005). Haldeman warns Nixon not to say anything because it would reveal Haldeman’s source, apparently some “legal guy” at the Post. Besides, “[I]f we move on [Felt], he’ll go out and unload everything. He knows everything that’s to be known in the FBI.” According to White House counsel John Dean, there are no legal sanctions that can be taken against Felt, because Felt has broken no laws. Dean is worried that if the White House takes any action, Felt will “go out and get himself on network television.” Nixon snarls: “You know what I’ll do with him, the little b_stard. Well, that’s all I want to hear about it.” Haldeman tells Nixon that Felt wants to be director of the FBI. Nixon’s first question: “Is he Catholic?” “No sir, he’s Jewish,” Haldeman replies. “Christ, put a Jew in there?” Nixon asks. “Well, that could explain it too,” Haldeman observes. [Woodward, 2005, pp. 85-86] Acting director L. Patrick Gray will inform Felt of the White House’s suspicions in early 1973, leading Felt to strenuously deny the charge, but Gray will refuse White House demands to fire Felt. Mark Felt, the infamous “Deep Throat” (see May 31, 2005). Woodward wants information connecting Nixon’s chief of staff, H. R. Haldeman, to the Nixon campaign “slush fund” (see Early 1970), but Felt, apparently afraid of crossing Haldeman (see October 19, 1972), refuses to provide anything specific.
Origin of Error - Woodward and his colleague, Carl Bernstein, attempt to secure confirmation of Haldeman’s role in Watergate through the treasurer of the Nixon campaign’s secret fund (see September 29, 1972), Hugh Sloan. The reporters misinterpret Sloan’s cautious statements as indirect confirmation that Sloan had testified to the FBI of Haldeman’s involvement. Additionally, they misinterpret guarded “confirmations” from two other sources. On October 25, the Post publishes a story about Sloan’s supposed assertions.
'All Hell Broke Lose' - Sloan’s attorney denies that his client ever made such an assertion in his testimony (Sloan will later confirm that Haldeman was indeed in charge of the secret fund, but he never testified to that fact). As Woodward later writes, “All hell broke loose.” Woodward and his partner Carl Bernstein, both clearly upset, offer to resign from the Post, an offer that is refused. The White House celebrates the error, calling into question every story Bernstein and Woodward wrote for the Post; Republican supporters such as Senator Bob Dole (R-KS) join in. Post executive editor Ben Bradlee—who stands by the story—will later say that the erroneous story is his personal low point in the history of the entire Watergate coverage.
Repercussions - Felt is furious with Woodward for the erroneous story. They may have lost Haldeman, Felt says, and worse, have spooked other sources that might otherwise have come forward. “You’ve got people feeling sorry for Haldeman. I didn’t think that was possible.… You put the investigation back months. It puts everyone on the defensive—editors, FBI agents, everybody has to go into a crouch after this.” The reporters write another story admitting the error about Sloan’s testimony, but saying that Haldeman did indeed control the secret campaign fund. Woodward even quotes Felt, identifying him as “one source,” an unprecedented breach of the procedures they have established in using Felt as a “deep background” source. Days after the Washington Post printed an incorrect story about Watergate grand jury testimony (see October 22-28, 1972), President Nixon tells aide Charles Colson that he plans to use the furor over the story to challenge the television licenses owned by the Post. “They should give some thought to taking on the guy that went into Cambodia and Laos, ran the Cambodian bombing campaign. What do the hell they think they’re doing in there?” Later, Nixon meets with Colson to again discuss his plan to challenge the Post’s television licenses. Nixon decides to abandon the plan, saying: “We’re going to screw them another way.… They don’t really realize how rough I can play.… But when I start, I will kill them. Clark MacGregor, the head of the Committee to Re-elect the President (CREEP), admits to the existence of a CREEP cash fund (see September 29, 1972). MacGregor disputes its secret nature, and says that it was not knowingly used for anything illegal—it was merely to learn of, and counter, possible efforts to sabotage Richard Nixon’s primary campaign. He says five people were authorized to disburse or receive payments from the fund: John Mitchell, Maurice Stans, Herbert L. “Bart” Porter, Jeb Magruder, and G. Gordon Liddy. The day before, press secretary Ron Ziegler had denied the fund’s existence. CREEP officials have testified that the fund had paid out over $900,000. [Bernstein and Woodward, 1974, pp. 194-195]

White House aide Charles Colson and Watergate burglar E. Howard Hunt discuss Hunt’s demand for “hush money” (see June 20-21, 1972 and March 21, 1973) in a telephone call. Hunt says he called “because the commitments that were made to all of us [Hunt and the other six burglars, all of whom are facing trial] have not been kept.” He continues: “There’s a great deal of concern on the part of the seven defendants. There’s a great deal of financial expense here that is not covered. What we’ve been getting has been coming in very minor drips and drabs. We’re now reaching a point at which—” “Don’t tell me any more,” Colson interjects. Hunt says, “[T]his thing should not break apart for foolish reasons,” which Colson interprets as a veiled threat that Hunt will begin talking to prosecutors about his involvement in the Watergate conspiracy. Colson seems to get the message: “Christ no.… You’ve told me all I need to know… the less I know really about what happened, the more help I can be to you.” Hunt says: “We’ve set a deadline now for the close of business on November 25 for the resolution, the liquidation of everything that’s outstanding.… I’m talking about promises from July and August. We could understand some hesitancy prior to the election (see November 7, 1972), but there doesn’t seem to be any of that now. Of course, we’re well aware of the upcoming problems of the Senate” (see February 7, 1973). Colson replies, “That’s where it gets hairy as hell.” Hunt continues: “We’re protecting the guys who were really responsible. That’s a continuing requirement. But this is a two-way street.… We think now is the time when some moves should be made, and surely your cheapest commodity is money.” [Reston, 2007, pp. 186-190] Shortly thereafter, Hunt receives more money from secret White House sources (see January 8-9, 1973).

Ben Klassen.Ben Klassen. [Source: Creativity Movement (.com)]Former Florida state legislator Benhardt “Ben” Klassen, who served as Florida chair of the 1968 presidential campaign of George Wallace (D-AL), forms the Church of the Creator (COTC) in Lighthouse Point, Florida. Klassen was born in the Ukraine in 1918, and later lived in Mexico and Canada before moving to California as an adult. He is a former elementary school teacher and an inventor, earning a patent for an electric can opener in 1954. He moved to Florida in 1958, where he became a successful real estate agent. He became a Republican representative to the Florida House of Representatives in 1965, where he campaigned against desegregation and the federal government. He is a lifetime member of the far-right John Birch Society (see March 10, 1961 and December 2011), though he has denounced the group as a “smokescreen for the Jews” and accused Wallace of “betraying” his supporters by intentionally courting African-American support. Klassen explains his race-based religion in his church’s 511-page holy book, Nature’s Eternal Religion. Among its “16 commandments”: “It is our sacred goal to populate the lands of this earth with White people exclusively.” Klassen popularizes the war cry “Rahowa,” which stands for RAcial HOly WAr. [Anti-Defamation League, 1993; Southern Poverty Law Center, 9/1999] Members of the COTC, according to Klassen’s writings, see “every issue, whether religious, political, or racial, [a]s viewed through the eyes of the White Man and exclusively from the point of view of the White race as a whole.… We completely reject the Judeo-democratic-Marxist values of today and supplant them with new and basic values, of which race is the foundation.” While most right-wing extremist groups use Christianity to justify their racism, Klassen and the COTC attack Christianity as a “tremendous weapon in the worldwide Jewish drive of race-mixing.” Klassen writes that Jews “concocted” Christianity “for the very purpose of mongrelizing and destroying the White Race.” According to Klassen, Jews are “parasites” who “control and manipulate the finances, the propaganda, the media, and the governments of the world.” [Anti-Defamation League, 7/6/1999] In 2004, author Chip Berlet will write that Klassen’s religion, “Creativity,” claims that whites are destined “to rule the world and thus fulfill the purpose of the universe. To attain this destiny, it is necessary to destroy the enemies and race traitors who prevent this from happening. The primary enemies are Jews, blacks, and other ‘mud people,’ and white race traitors, including most Christians. Klassen credits the influence of Hitler’s Mein Kampf in the development of his views.… What Klassen did was to pick up ideas from the theories of [German philosopher Friedrich] Nietzsche, pantheisim, Odinism, and Celtic paganism as filtered through German Nazi retelling of the Norse heroic warrior myths, to create a religion of Aryanist white supremacy. Discarding the details, he created a form of cosmotheism in which the supreme power is the collective will of the Aryan race. The duty of every member of the Aryan race is to reflect the ideals of the heroic warrior and do battle with the enemies of the race.… Like other forms of fascism, the idea of action is central to the philosophy, as is the celebration of violence and the spilling of blood as part of a rite of passage to full adulthood.” [Chip Berlet, 2004]

President Nixon and senior aide Charles Colson discuss the Watergate trial just underway (see January 8-11, 1973). Nixon has apparently just learned that someone in his re-election campaign planted electronic surveillance on Gary Hart, Democratic presidential candidate George McGovern’s campaign manager. Nixon tells Colson: “I understand [chief of staff H. R.] Haldeman is after some kid that bugged Gary Hart.… But how could that be? Watergate came before McGovern got off the ground, and I don’t know why the hell we bugged McGovern.” Colson replies: “Remember. That was after the California primary” (where McGovern clinched the nomination). Nixon grouses: “That’s the thing about all of this. We didn’t get a g_ddamn thing from any of it that I can see.” Colson disagrees: “Well, frankly, we did, but then, what they mainly used, we know.” Later in the conversation, Nixon brings up the problem of Watergate burglar E. Howard Hunt, who has what Nixon calls a “sensitive position” in the Watergate investigation—Hunt knows enough to blow the lid off the entire conspiracy, and has threatened to reveal it if he is not paid (see Mid-November, 1972). Colson says: “The others [the other six defendants] will just tell the truth and prove their case. But there is one advantage to it. There’ll be a hell of a lot of stuff that’ll come out.… Some counts will be dropped against Hunt. There will be appeals pending in the other cases.” Nixon adds, “As long as this trial is going on, the Congress will keep its g_ddamn, cotton-pickin’ hands off that trial.” Colson is sure the Senate Watergate Committee (see February 7, 1973) will begin immunizing witnesses to testify.
Using the CIA Connection - As the conversation moves on, Colson agrees with Nixon that he thought the Democrats might drop their interest in the burglary after the election, especially since “I think they figured that these were all guys who were CIA.… And they were all taking orders from people… acting on behalf of John Mitchell [the former head of Nixon’s re-election campaign].” Nixon says that it should be a simple thing to grant Hunt executive clemency, considering Hunt’s wife is dead and he has a child with permanent brain damage suffered in an automobile accident. “We’ll build that son of a b_tch up like nobody’s business. We’ll have Buckley write a column and say that he should have clemency, if you’ve given 18 years of service.” Colson adds that Buckley “served under Hunt in the CIA.” (Conservative columnist William F. Buckley became a CIA agent in 1951, and worked under Hunt in Mexico City.)
Abandoning Five of the Burglars - The five Cuban burglars, Colson says, are irrelevant. They “didn’t have any direct information.… I don’t give a damn if they spend five years in jail…. They can’t hurt us.… Hunt and [G. Gordon] Liddy: direct meetings and discussions are very incriminating to us.” Colson is not worried so much about Liddy, saying: “Apparently he’s one of those masochists. He enjoys punishing himself. That’s okay, as long as he remains stable. I mean, he’s tough…. [Hunt and Liddy are] both good, healthy, right-wing exuberants.” Nixon says wearily, “This… is the last damn fifty miles.” [Reston, 2007, pp. 191-195]

During the Watergate trial of G. Gordon Liddy and James McCord (see January 30, 1973), Washington Post reporters Carl Bernstein and Bob Woodward begin poring over the exhibits and papers filed as evidence with the court. Woodward begins calling the phone numbers listed in the address books of the burglars (see June 18, 1972). He is told by one of the first people he calls: “The FBI? They never, never contacted me. I never talked to them.” Woodward is appalled that the FBI has made such a fundamental investigative failure of not calling all of the people listed in the books. (An FBI internal report will later attempt to explain the lapse—see July 5, 1974.)
Woodward Calls Witnesses - When the court releases the names of upcoming witnesses, Woodward begins calling them, too. He asks one witness, who knows burglar E. Howard Hunt (see January 8-9, 1973) very well, what he will testify to. “I’ll tell you what I could testify to, but [prosecutor Earl] Silbert won’t ask,” the witness replies. “If the judge does or any of the attorneys, I’ll say it.” The witness has already told everything he knows to Silbert and FBI investigators.
Ehrlichman Allegedly Ran Plumbers - He says that if asked, he would tell the court that, according to Hunt, White House aide John Ehrlichman was in charge of the Plumbers (see December 7, 1972). Hunt would have rather dealt with another White House aide, Charles Colson, “because Colson understood that such [secret intelligence gathering operations against political opponents] are necessary.” Ehrlichman was reluctant to implement some of Hunt’s schemes, the witness says, but Colson pushed them through. Former Nixon campaign chief John Mitchell received typed logs and reports of the wiretaps on the Democrats, the witness says.
Conspiracy Linked to Dean - Most surprisingly for Woodward, the witness says that when Hunt was in hiding from investigators (see June 18, 1972) and demanding a lawyer, he insisted that White House counsel John Dean find him one. This is the first time anyone has publicly connected Dean to the Watergate conspiracy.
Not Asked - As the witness predicts, he will not be asked any of this when he testifies. Woodward and Bernstein write a long analysis of the trial, headlined “Still Secret: Who Hired Spies and Why,” observing that the Liddy/McCord trial is notable for “questions that were not asked, answers that were not given, witnesses who were not called to testify, and some lapses of memory by those who were.” At the bond hearing for Liddy and McCord after the trial, Judge John Sirica will say that he hopes the proposed Senate investigation (see February 7, 1973) can find out what the trials did not. The majority opinion is written by Justice Harry Blackmun; he is joined by Chief Justice Warren Burger and Justices William O. Douglas, William Brennan, Potter Stewart, Thurgood Marshall, and Lewis Powell. Justices Byron “Whizzer” White and William Rehnquist dissent from the opinion. Blackmun’s majority opinion finds that the 14th Amendment’s guarantees of personal liberty and previous decisions protecting privacy in family matters include a woman’s right to terminate her pregnancy. White’s dissent argues that the Court has “fashion[ed] and announce[d] a new constitutional right for pregnant mothers and, with scarcely any reason or authority for its action, invest[ed] that right with sufficient substance to override most existing state abortion statutes.” The decision does not make abortion freely available to women in any stage of pregnancy. It places the following constraints:
bullet No restrictions on availability are made during the first trimester (three months) of a woman’s pregnancy.
bullet Because of increased risks to a woman’s health during the second trimester, the state may regulate the abortion procedure only “in ways that are reasonably related to maternal health.”
bullet In the third and final trimester, since the rate of viability (live birth) is markedly greater than in the first two trimesters, the state can restrict or even prohibit abortions as it chooses, “except where it is necessary, in appropriate medical judgment, for the preservation of the life or health of the mother.”
Originally brought to challenge a Texas law prohibiting abortions, the decision disallows a host of state and federal restrictions on abortion, and sparks an enormous controversy over the moral, religious, and legal viability of abortion that continues well into the 21st century. [ROE v. WADE, 410 US 113 (1973), 1/22/1973; CNN, 1/22/2003; National Abortion Federation, 2010] In a related case, Roe v. Bolton, the Court strikes down restrictions on facilities that can be used to provide abortions. The ruling leads to the establishment of so-called “abortion clinics.” [CBS News, 4/19/2007]

Four of President Nixon’s most trusted aides, H. R. Haldeman, John Ehrlichman, John Dean, and Richard Moore, meet at the La Costa Resort Hotel near Nixon’s home in San Clemente, California, to plan how to deal with the upcoming Senate Watergate Committee hearings (see February 7, 1973). The meetings are detailed in later testimony to the committee by Dean (see June 25-29, 1973). The group debates over which senators will be friends and which will be foes. Ehrlichman quips that Daniel Inouye (D-HI) should be called “Ain’t No Way” because “there ain’t no way he’s going to give us anything but problems.” Lowell Weicker (R-CT) is a Republican, but, says Dean, “an independent who could give the White House problems.” No one is sure which way co-chairman Howard Baker (R-TN) might go (see February 22, 1973). The only sure bet is Edward Gurney (R-FL), who one participant describes as “a sure friend and protector of the president’s interests” (see April 5, 1973). The aides decide to pretend to cooperate with the committee, but in reality, according to Dean’s testimony, “to restrain the investigation and make it as difficult as possible to get information and witnesses.” They discuss how to blame Democrats for similar, Watergate-like activities during their campaigns. Dean is taken aback when Haldeman suggests that the Nixon re-election campaign should “hire private investigators to dig out information on the Democrats.” Dean objects that such an action “would be more political surveillance.” But, he later testifies, “the matter was left unresolved.” [Time, 7/9/1973]

The chairman is Sam Ervin (D-NC), whose carefully cultivated image as a folksy “country lawyer” camouflages a keen legal mind. Ervin’s deputy is Howard Baker (R-TN). [Gerald R. Ford Library and Museum, 7/3/2007] Senate Republicans attempt to dilute the effectiveness of the investigative committee with resolutions demanding probes into the 1964 and 1968 elections as well—Hugh Scott (R-PA) says there is “wholesale evidence of wiretapping against the Republicans” in the 1968 campaign, yet refuses to present any evidence—but those resolutions fail in floor votes. After the vote, Washington Post reporter Bob Woodward learns that the resolutions were drafted by White House lawyers. [Bernstein and Woodward, 1974, pp. 250-251] Ervin, already chosen to head the committee, told fellow senator Edward Kennedy (D-MA), who held his own ineffective senatorial investigation, that he knew little more about the Watergate conspiracy than what he read in the papers, but “I know the people around [President] Nixon, and that’s enough. They’re thugs.” [Bernstein and Woodward, 1974, pp. 247] Ervin has already contacted Woodward and asked him to help him compile information. Ervin implies that he wants Woodward to convince his unnamed sources to come forward and testify. Woodward demurs, but he and colleague Carl Bernstein write a story reporting Ervin’s intention to call President Nixon’s top aides, including H. R. Haldeman, to testify. In a conversation about Watergate with senior aide Charles Colson, President Nixon says: “When I’m speaking about Watergate, though, that’s the whole point, where this tremendous investigation rests. Unless one of the seven [burglars] begins to talk. That’s the problem.” [Reston, 2007, pp. 43-44] Colson and Nixon want to decide how to limit the exposure of top White House aides to the Congressional inquiry (see February 7, 1973), perhaps by allowing access to lower-level officials. Nixon says: “You can let them have lower people. Let them have them. But in terms of the people that are direct advisers to the president, you can say they can do it by written interrogatories, by having [Senate Watergate Committee head Senator Sam] Ervin and the two counsels conduct interrogatories. But don’t go up there on television (see May 17-18, 1973).” Colson believes “it’s a good compromise,” and Nixon goes on to say that he has considered not letting anyone testify, but “I’m afraid that gives an appearance of total cover-up, which would bother me a bit.… You let them have some others.… That’s why you can’t go. The people who have direct access to the president can’t go.” Later in the conversation, Colson makes a bold suggestion: “The other point is, who did order Watergate? If it’s gonna come out in the hearings, for God’s sakes, let it out now.… Least get rid of it. Take our losses.” Nixon asks: “Well, who the hell do you think did this? Mitchell [referring to John Mitchell, the former head of the Nixon re-election campaign]? He can’t do it. He’ll perjure himself. He won’t admit it. Now, that’s the problem. Magruder [Jeb Magruder, Mitchell’s former deputy]?” “I know Magruder does,” Colson says. Nixon responds, “Well, then he’s already perjured himself, hasn’t he?” Colson replies, “Probably.” Nixon knows what to do if and when he or either of his top two aides, H. R. Haldeman and John Ehrlichman, are called to testify. “In the case of Haldeman, Ehrlichman, and me, the only three you can probably do this with, they should either be written interrogatories or appointive-type things where they list out some highly specific areas. And that’s it and not beyond that. If they try to get beyond that, you just stonewall it or you just don’t remember something when you don’t have to.” [Reston, 2007, pp. 196-199]

William Sullivan, a high-ranking FBI official with decades of experience in conducting covert intelligence operations against anti-war and civil rights organizations and the chief of the FBI’s investigation into the assassinations of John F. Kennedy and Martin Luther King, Jr, writes a memo to White House counsel John Dean offering some advice on how the White House should handle the burgeoning Watergate investigation. Sullivan blasts the entire operation for “atrocious judgment” and a “lack of professionalism and competency.” He then turns to the problem of handling the Senate investigation (see February 7, 1973). There are three major elements in the Watergate conspiracy, Sullivan writes: “the breaking and entering of the [Watergate] building… the applications of technical surveillances… [and] the financing.” Sullivan observes that the financing “might turn out to be the most serious and harmful element in the problem.” Sullivan then turns to some of the details of the defense:
bullet If the Senate investigation turns out to be a relatively limited and partisan probe, then the White House should, Sullivan counsels, sit back, deny everything, and wait for it to run its course. If the investigation is “real and exhaustive,” then “sitting tight” is “the wrong tactic.”
bullet Sullivan recommends hiring a top-flight legal representative, preferably someone with a reputation for integrity and bipartisanship, and recommends having only “one or two men in high authority” working with that lawyer to ensure that the lawyer only hears what the White House wants him to hear. Another lawyer should be hired as an assistant, one who knows the Senate well and has experience in the Washington “jungle.”
bullet When the Senate investigation launches its probe, press secretary Ron Ziegler should “issue a very clear, forceful and carefully constructed statement in representing the president, condemning again the Watergate activities and saying that he has instructed all concerned in the government to give their complete and willing cooperation to Senator Ervin and his colleagues.”
bullet Sullivan writes that avoiding or downplaying specific issues would be a mistake. Instead, each issue should “be faced openly, briefly and without equivocation.” The investigation needs to be as brief as possible.
bullet The overriding purpose of the Watergate defense should be to protect Richard Nixon and the Office of the President. “If worse comes to worse, bearing in mind the main objectives stated above, those involved in the Watergate affair should be considered expendable in the best interests of the country. Their culpability should be set forth in its entirety thereby directing the attention of the probers and the attention of the reading public away from the White House and to the men themselves where the blame belongs.”
Sullivan says that he knows little about the financial element of the Watergate conspiracy, but again warns of the potential damage it could cause. “[I]f it is as serious as I think it could be then those fully knowledgeable in this area should give the matter the most searching thought possible. Convicted Watergate burglar James McCord (see January 30, 1973) writes a letter to the presiding judge, John Sirica, in response to Sirica’s requests for more information. McCord writes that he is “whipsawed in a variety of legalities”—he may be forced to testify to the Senate (see February 7, 1973), and he may be involved in future civil and other criminal proceedings. He also fears unspecified “retaliatory measures… against me, my family, and my friends should I disclose” his knowledge of the Watergate conspiracy. But McCord wants some leniency from Sirica in sentencing. McCord alleges that the five defendants who pled guilty did so under duress. The defendants committed perjury, McCord continues, and says that others are involved in the burglary. The burglary is definitely not a CIA operation, though “[t]he Cubans may have been misled” into thinking so. McCord writes, “I know for a fact that it was not,” implying inside knowledge of at least some CIA workings. McCord requests to speak with Sirica privately in the judge’s chambers, because he “cannot feel confident in talking with an FBI agent, in testifying before a Grand Jury whose US attorneys work for the Department of Justice, or in talking with other government representatives.” In his discussion with Sirica, he makes the most explosive charge of all: he and his fellow defendants lied at the behest of former Attorney General John Mitchell, now the head of the Nixon re-election campaign, and current White House counsel John Dean. The committee’s ranking minority member, Howard Baker (R-TN), tells reporters after the lengthy session that McCord has provided “significant information… covering a lot of territory.” One senator anonymously tells Washington Post reporters Carl Bernstein and Bob Woodward of McCord’s testimony: McCord has told the senators that fellow Watergate burglar G. Gordon Liddy said the burglary and surveillance operation was approved by then-Nixon campaign chairman John Mitchell in February 1972, while Mitchell was still attorney general (see March 20, 1971). In addition, McCord told the senators that White House aide Charles Colson knew about the Watergate operation in advance. Little of this is news to the Post reporters, and they are not heartened by Baker’s admission that McCord’s testimony is almost all secondhand information. White House counsel John Dean begins cooperating with the Watergate prosecutors. [Gerald R. Ford Library and Museum, 7/3/2007] Dean has already been asked to resign and has refused, fearing that President Nixon and his top aides will try to pin the blame for Watergate on him. Shortly after agreeing to cooperate with the investigation, Dean issues a statement making it clear that he is unwilling to be a “scapegoat in the Watergate case.” [Spartacus Schoolnet, 8/2007] According to an associate of Dean’s, when Dean told Nixon that he and aides H. R. Haldeman and John Ehrlichman would have to go to jail to protect the presidency (see March 21, 1973), Nixon seemed resigned to the possibility. But shortly thereafter, Haldeman and Ehrlichman convinced Nixon that Dean could be the “fall guy” for the entire White House. “Instead of agreeing to cooperate, they are still telling [Nixon] that John should walk the plank for all of them. [Nixon] is ready to give John the final shove.” A Nixon campaign official will verify the Dean associate’s account, and say that Dean wanted to be honest, but was following orders from Haldeman and Ehrlichman. [Bernstein and Woodward, 1974, pp. 305] Dean will soon begin sharing evidence that implicates Haldeman and Ehrlichman in the Watergate conspiracy (see June 25-29, 1973). [Washington Post, 5/1/1973]

McCord’s testimony is the first confirmation that CREEP bought the silence of the burglars during their trial (see January 8-11, 1973). Washington Post reporter Bob Woodward, attempting to confirm earlier information that the CREEP “slush fund” had continued to operate well after the Watergate burglaries (see 2:30 a.m.June 17, 1972), speaks to a CREEP official; the official explodes about the reaction among his colleagues to McCord’s testimony. “John Mitchell [the former head of CREEP] still sits there smoking on his pipe, not saying much… I used to take that for wisdom—you know, keeping your mouth shut. Now I realize that it’s ignorance.… God, I never thought I’d be telling you guys that I didn’t hate what you did. It’s the way the White House has handled this mess that’s undermined the presidency.… I’ve got friends who look at me now and say, ‘How can you have any self-respect and still work for CREEP?’ I’m sick.” Former CREEP treasurer Hugh Sloan confirms that at least $70,000 of the “slush fund” money (see Early 1970 and September 29, 1972)was used to pay off the burglars, all with the approval of CREEP financial director Maurice Stans. Woodward and colleague Carl Bernstein will later write: “That tied the knot. At Camp David, White House press secretary Ron Ziegler tells White House Chief of Staff H. R. Haldeman that President Nixon is considering resigning. Haldeman replies: “That’s not going to happen. He’s just steeling himself to meet with us (see April 24, 1973). He’s creating a big crisis he can’t meet, so that he can meet the lesser crisis of dealing with us.” When the two meet with Nixon, Haldeman is shocked at how bad Nixon looks. Standing on the porch of the Aspen Lodge, Nixon, looking at the spring foliage, says, “I have to enjoy this because I may not be alive much longer.” Nixon says he prayed last night not to wake up this morning. A horrified Haldeman tries to reassure Nixon that he accepts Nixon’s decision to ask for his resignation. “What you have to remember,” he says, “is that nothing that has happened in the Watergate mess has changed your mandate in the non-Watergate areas. That is what matters. That is what you do best.” Nixon then meets with White House aide John Ehrlichman and tells Ehrlichman the same thing he told Haldeman—that he prayed not to wake up in the morning. “Don’t think like that,” Ehrlichman says. Nixon begins to cry. “This is like cutting off my arms,” he says. “You and Bob, you’ll need money. I have some—Bebe [Rebozo, Nixon’s millionaire friend] has it—and you can have it.” Ehrlichman replies: “That would just make things worse. You can do one thing for me, though, sometime. Just explain all of this to my kids, will you?” When Ehrlichman leaves, Ziegler joins Nixon in the lodge and Nixon says, “It’s all over, Ron, do you know that?” Ziegler knows Nixon means his presidency. Later, Nixon tells his speech writer, Ray Price, who is working on Nixon’s announcement of the resignations of Haldeman and Ehrlichman (see April 30, 1973): “Maybe I should resign, Ray. If you think so just put it in” the speech. Nixon walks towards the swimming pool, and Price stays close behind him, fearing that Nixon might attempt to drown himself. [Reeves, 2001, pp. 600-602]

[Source: Washington Post]Former White House counsel John Dean has told Watergate investigators that he discussed the Watergate cover-up with President Nixon at least 35 times [Gerald R. Ford Library and Museum, 7/3/2007] between January and April of 1973, according to sources quoted by the Washington Post. Dean plans on testifying to his assertions in the Senate Watergate hearings (see May 17-18, 1973), whether or not he is granted immunity from prosecution. He will also allege that Nixon himself is deeply involved with the Watergate cover-up. Nixon had prior knowledge of payments used to buy the silence of various Watergate conspirators, and knew of offers of executive clemency for the conspirators issued in his name. Dean has little solid evidence besides his own personal knowledge of events inside the White House.
Haldeman, Ehrlichman, Nixon Central Figures in Cover-Up - Dean will testify that two of Nixon’s closest aides, H. R. Haldeman and John Ehrlichman (see April 30, 1973), were also present at many of the meetings where the cover-up was discussed in Nixon’s presence. The White House, and Haldeman and Ehrlichman, have tried to portray Dean as the central figure in the Watergate conspiracy, and the Justice Department says there is ample evidence to indict Dean for a number of crimes related to the cover-up. Dean and his supporters paint Dean as a White House loyalist who merely did what he was told, until he began agonizing over the effect Watergate was having on Nixon. Dean alleges that Nixon asked him how much the seven Watergate defendants (see June 17, 1972) would have to be paid to ensure their silence, aside from the $460,000 already paid out; when Dean replied that the cost would be around $1 million, Nixon allegedly replied that such a payoff would be no problem. Dean has told investigators that later Nixon insisted he had been merely “joking” about the payoff. Dean says by that time—March 26—Nixon knew that Dean would be cooperating with the Watergate investigation, and that he believes Nixon was trying to retract the statement for his own legal well-being.
Pressured to Confess - Dean has also testified that Nixon tried to force him to sign a letter of resignation that would have amounted to a confession that Dean had directed the Watergate cover-up without the knowledge of Nixon, Haldeman, or Ehrlichman. When Dean refused to sign, he says, Nixon warned him “in the strongest terms” never to reveal the Nixon administration’s covert activities and plans. Dean also says that Nixon personally directed the White House’s efforts to counterattack the press over Watergate (see October 16-November, 1972). Until January 1, Dean has told investigators, he usually reported to Haldeman and Ehrlichman regarding his Watergate-related activities, but after that date Nixon began taking more of an active role in dealing with Dean, and gave Dean direct orders on handling the cover-up.
Reliable Witness - Dean has so far met eight times with the Watergate prosecutors, and twice with the chief legal counsel of the Senate Watergate committee, Samuel Dash. Dash and the prosecutors find Dean a compelling and believable witness. “[E]verything we have gotten from Dean that we were able to check out has turned out to be accurate,” says one Justice Department source. Dean says he tried without success to obtain records that would support his allegations in his final days in the White House, and believes that many of those records may have been destroyed by now. Dean did manage to remove some secret documents before his firing, documents that prompted Nixon to recently admit to “covert activities” surrounding Watergate. Dean’s information has already led to the revelation of the burglary of the office of Pentagon Papers leaker Daniel Ellsberg (see September 9, 1971), and to the resignation of FBI director L. Patrick Gray after Gray was found to have destroyed evidence taken from the safe of Watergate burglar E. Howard Hunt (see June 28, 1972). [Washington Post, 6/3/1973]

Dean gives a seven-hour opening statement detailing a program of political and campaign espionage activities conducted by the White House in recent years. He also tells the committee that he believes Nixon has tape-recorded some of the conversations regarding the Watergate conspiracy (see July 13-16, 1973). Dean tells the committee that he has White House documents detailing elements of the conspiracy in a safe-deposit box, and has given the keys to that box to Judge John Sirica, the judge overseeing the Watergate prosecutions. [Gerald R. Ford Library and Museum, 7/3/2007; Spartacus Schoolnet, 8/2007] Dean, described by Time Magazine as “owlish” and speaking “in a lifeless monotone,” nevertheless displays “impressive poise and a masterly memory” as he “sp[ins] his detailed web of evidence. He readily admit[s] his own illegal and improper acts. But he emerge[s] unshaken from five full days of recital and cross examination, with his basic story challenged but intact.” Without a convincing rebuttal, it would be difficult for either the committee or the nation to believe that Nixon “was not an active and fully aware participant in the Watergate cover-up, as Dean charged.”
Implicates Nixon Aides - While Dean admits that he had no first-hand knowledge of Nixon’s complicity until September 1972, he directly implicates Nixon’s two most senior aides at the time, H. R. Haldeman and John Ehrlichman, of what Time calls “multiple actions in the Watergate coverup,” as well as former Nixon campaign chairman John Mitchell.
White House-Sourced Questioning of Dean Backfires - An initial White House attempt at rebutting Dean’s testimony, consisting of a statement and a list of questions drawn up by White House counsel Fred Buzhardt, are “easily handled” by Dean, and even backfires, to the point where the White House disavows any involvement in the material, saying that they were “Buzhardt’s friendly personal contribution to the proceedings.” The questions attempt to portray Dean as the “mastermind” behind the Watergate conspiracy, with Mitchell his “patron.” Time writes, “Creating a constitutional crisis almost alone, the Buzhardt statement in effect charge[s], Dean and Mitchell kept the truth of all that concealed for some nine months from such shrewd White House officials as H. R. Haldeman, John Ehrlichman, Charles W. Colson—and the president.” But few on the committee find Buzhardt’s contention believable, considering the increasing amount of evidence to the contrary.
Testimony Details 'Climate of Fear' at White House - As yet much of Dean’s testimony remains uncorroborated, but, Time writes: “even if those facts leave many unconvinced of Nixon’s complicity in Watergate, Dean’s dismaying description of the climate of fear existing within the Nixon White House is almost as alarming as the affair that it spawned. With little regard for the law and under repeated proddings by the president himself. Dean contended, the Nixon staff used or contemplated using almost any available tactic to undermine political opponents, punish press critics, subdue antiwar protesters and gather political intelligence, including lists of ‘enemies’” (see June 27, 1973). Overall, Dean says, the Watergate break-in (see 2:30 a.m.June 17, 1972) was “the first act in a great American tragedy” and he finds it “very difficult” to testify about what others, including “men I greatly admire and respect,” had done. He finds it easier to admit to his own crimes. [Time, 7/9/1973]

[Source: Quixoticals]Former White House counsel John Dean, continuing his testimony before the Senate Watergate Committee (see June 25-29, 1973), provides a sheaf of documents to the committee. Among those is the “Opponents List and Political Enemies Project,” informally called President Nixon’s “enemies list.” The list is actually a set of documents “several inches thick” of names and information about Nixon’s political enemies. It was compiled by a number of administration officials, including Dean, White House aides Charles Colson, Gordon Strachan, and Lyn Nofziger, beginning in 1971. One of the documents from August 16, 1971, has Dean suggesting ways in which “we can use the available federal machinery to screw our political enemies.” Methods proposed included administration manipulation of “grant availability, federal contracts, litigation, prosecution, etc.” The Dean memo was given to then-chief of staff H. R. Haldeman and top White House aide John Ehrlichman for approval. Though Dean testifies that he does not know if the plan was set into motion, subsequent documents submitted to the committee indicate that it was indeed implemented. A condensed list of 20 “White House enemies” was produced by Colson’s office; a larger list included ten Democratic senators, all 12 black House members, over 50 news and television reporters, prominent businessmen, labor leaders, and entertainers, and contributors to the 1972 presidential campaign of Democratic senator Edmund Muskie. The condensed list includes, in priority order:
bullet “1. Arnold M. Picker, United Artists Corp., NY. Top Muskie fund raiser. Success here could be both debilitating and very embarrassing to the Muskie machine. If effort looks promising, both Ruth and David Picker should be programmed and then a follow through with United Artists.”
bullet “2. Alexander E. Barkan, national director of AFL-CIO’s committee on Political Education, Washington D.C.: Without a doubt the most powerful political force programmed against us in 1968 ($10 million, 4.6 million votes, 115 million pamphlets, 176,000 workers—all programmed by Barkan’s COPE—so says Teddy White in The Making of the President 1968). We can expect the same effort this time.”
bullet “3. Ed Guthman, managing editor, Los Angeles Times: Guthman, former Kennedy aide, was a highly sophisticated hatchetman against us in ‘68. It is obvious he is the prime mover behind the current Key Biscayne effort. It is time to give him the message.”
bullet “4. Maxwell Dane, Doyle, Dane and Bernbach, NY: The top Democratic advertising firm—they destroyed Goldwater in ‘64. They should be hit hard starting with Dane.”
bullet “5. Charles Dyson, Dyson-Kissner Corp., NY: Dyson and [Democratic National Committee chairman] Larry O’Brien were close business associates after ‘68. Dyson has huge business holdings and is presently deeply involved in the Businessmen’s Educational Fund which bankrolls a national radio network of five-minute programs—anti-Nixon in character.”
bullet “6. Howard Stein, Dreyfus Corp., NY: Heaviest contributor to [Democratic presidential candidate Eugene] McCarthy in ‘68. If McCarthy goes, will do the same in ‘72. If not, Lindsay or McGovern will receive the funds.”

Drinan, Robert Kastenmeier, Wright Patman; African-American representatives Shirley Chisholm, William Clay, George Collins, John Conyers, Ronald Dellums, Charles Diggs, Augustus Hawkins, Ralph Metcalfe, Robert N.C. Nix, Parren Mitchell, Charles Rangel, Louis Stokes; and several other politicians, including Lindsay, McCarthy, and George Wallace, the governor of Alabama (see May 15, 1972). It was so wonderful that one of my colleagues that I will not mention, but a very important man at CBS, said, ‘Why you, Schorr? Butterfield reveals that since 1971, President Nixon has been recording every conversation and telephone call in the Oval Office. [Gerald R. Ford Library and Museum, 7/3/2007] Butterfield is actually the aide who, at Nixon’s request, had the taping system installed. [Sussman, 1974] He is now the administrator of the Federal Aviation Administration.
Taping System Installed in 1970 at Nixon's Behest - Butterfield says the taping system was installed in the spring or summer of 1970, but corrects his testimony after committee chairman Sam Ervin reads him a letter from Nixon lawyer Fred Buzhardt stating that the first time the system was used was the spring of 1971; Butterfield then says the system was installed at that time (see February 1971). The system was installed and operated by Secret Service agents. Asked why Nixon would have such a system, Butterfield replies, perhaps ingenuously, “There was no doubt in my mind they were installed to record things for posterity, for the Nixon library.” Committee counsel Samuel Dash says the committee will request selected tapes to hear for themselves. Watergate prosecutor Archibald Cox is also expected to request some of the tapes. Dash acknowledges that two other Nixon aides, H. R. Haldeman and Lawrence Higby, were also asked about the existence of the taping system, but both have refused to confirm the existence of the device. [Washington Post, 7/17/1973] Secretary of State Henry Kissinger’s deputy, Alexander Haig, also knew of the taping system, but Kissinger himself did not know. Former White House counsel John Dean suspected that such a system existed. [Bernstein and Woodward, 1974, pp. 331]
'Small Fry' - Butterfield is described by one reporter as a “small fry,” the man responsible for keeping Nixon’s schedule and handling paper flow. On July 13, three committee staff members prepare Butterfield for his public testimony of July 16. They ask whether there is a White House recording system, but are not prepared for Butterfield’s answer, or the ramifications of his admission. Butterfield makes the same admission three days later, in open testimony before the committee and the television cameras, and in more detail. [Houston Chronicle, 6/7/1997] Butterfield explains his reluctance to discuss the recording system by saying, “It is very obvious that this could be—I cannot say that any longer—is embarrassing to our government.” [Washington Post, 7/17/1973]
No Longer Dean's Word Against Nixon's - During preparation, when the staff members ask Butterfield how the White House could have such detailed knowledge of the conversations, Butterfield replies: “I was hoping you guys wouldn’t ask me that.… Well, yes, there’s a recording system in the White House.” Nixon had had five voice-activated microphones placed in his desk in the Oval Office and two in wall lamps by the office fireplace, Butterfield reveals. More were in the Cabinet Room, Nixon’s “hideaway” office in the Old Executive Office Building, and even at Camp David, the presidential retreat. Before Butterfield’s testimony, Nixon and his top legal advisers felt they could duck and deny the worst charges against them. They feel that much of the Watergate imbroglio boils down to Nixon’s word against White House whistleblower John Dean (who had informed the committee that he suspected a recording system existed), and as Haig, who succeeded Haldeman as Nixon’s chief of staff, told Nixon: “Nobody in Congress likes [Dean]. We can take the son of a b_tch on.” Few in the White House know of Nixon’s secret and extensive taping system. Although senior Nixon aide H. R. Haldeman had told the few aides who do know of the system to invoke executive privilege and refuse to discuss it, Haig quietly told at least one aide, his former deputy Lawrence Higby, to “tell the truth” if asked under oath. Nixon’s lawyers had effectively rebutted Dean’s earlier testimony when Buzhardt secretly supplied a sympathetic Senate lawyer with highly detailed, nearly verbatim accounts of Nixon and Dean’s private conversations—accounts drawn from the secret tapes. Haig will later claim to be “shocked” at Butterfield’s revelation, saying, “It never occurred to me that anyone in his right mind would install anything so Orwellian as a system that never shut off, that preserved every word, every joke, every curse, every tantrum, every flight of presidential paranoia, every bit of flattery and bad advice and tattling by his advisers.” In reality, Haig had known of the system for months before Butterfield’s testimony, and had advised Nixon to have the tapes destroyed before the Watergate prosecutors could get their hands on them. [Washington Post, 7/17/1973; Werth, 2006, pp. 81-82] “Without the tapes,” reporter Mike Feinsilber will write in 1997, “it was unlikely Nixon would have had to give up the presidency.” [Houston Chronicle, 6/7/1997] Butterfield was considered so unimportant that, had Washington Post reporters Bob Woodward and Carl Bernstein not pressured committee lawyers to interview him, the committee may not have bothered with him. [Source: Southern Methodist University]President Nixon delivers his second prime-time televised speech about Watergate to the nation. He says that both the Senate investigations have focused more on trying to “implicate the president personally in the illegal activities that took place,” and reminds listeners that he has already taken “full responsibility” for the “abuses [that] occurred during my administration” (see April 30, 1973). But in light of the increasing evidence being revealed about the Watergate conspiracy, Nixon’s speech is later proven to be a compilation of lies, half-truths, justifications, and evasions.
'No Prior Knowledge' - He again insists that “I had no prior knowledge of the Watergate break-in; I neither took part in nor knew about any of the subsequent cover-up activities; I neither authorized nor encouraged subordinates to engage in illegal or improper campaign tactics. That was and that is the simple truth.” He says that in all the Senate testimony, “there is not the slightest suggestion that I had any knowledge of the planning for the Watergate break-in.” He says only one witness has challenged his statement under oath, referring to former White House counsel John Dean (see April 6-20, 1973) and June 25-29, 1973), and says Dean’s “testimony has been contradicted by every other witness in a position to know the facts.” Instead, says Nixon, he insisted from the outset that the investigation into the Watergate burglary be “thorough and aboveboard,” and if there were any evidence of “higher involvement, we should get the facts out first.” A cover-up would be unconscionable, he says. He again insists that he was told in September 1972 that an FBI investigation, “the most extensive investigation since the assassination of President Kennedy… had established that only those seven (see June 17, 1972) were involved.” Throughout, Nixon says, he relied on the reports of his staff members, Justice Department, and FBI officials, who consistently reassured him that there was no involvement by anyone in the White House in the burglaries. “Because I trusted the agencies conducting the investigations, because I believed the reports I was getting, I did not believe the newspaper accounts that suggested a cover-up. I was convinced there was no cover-up, because I was convinced that no one had anything to cover up.”
Internal Investigation - He didn’t realize that those assurances were wrong until March 21, when he “received new information from [Dean] that led me to conclude that the reports I had been getting for over nine months were not true.” He immediately launched an internal investigation (see August 29, 1972), initially relying on Dean to conduct the investigation, then turning the task over to his senior aide, John Ehrlichman, and to the Attorney General, Richard Kleindienst. The results prompted him to give the case to the Criminal Division of the Justice Department, ordering the complete cooperation of “all members of the administration.” He never tried to hide the facts, Nixon asserts, but instead has consistently tried “to discover the facts—and to lay those facts before the appropriate law enforcement authorities so that justice could be done and the guilty dealt with.”
Refusal to Turn over Tapes; 'Privileged' Communications - Nixon says he is resisting subpoenas to turn over the secret recordings he has had made of White House and other conversations (see July 13-16, 1973) because of “a much more important principle… than what the tapes might prove about Watergate.” A president must be able to talk “openly and candidly with his advisers about issues and individuals” without having those conversations ever made public. These are “privileged” conversations, he says, similar to those between a lawyer and his client or “a priest and a penitent.” The conversations between a president and his advisers, Nixon says, are “even more important.” The conversations on those tapes are “blunt and candid,” made without thought to any future public disclosure, and for future presidents and their advisers to know that their conversations and advice might one day be made public would cripple their ability to talk freely and offer unfettered opinions. “That is why I shall continue to oppose efforts which would set a precedent that would cripple all future presidents by inhibiting conversations between them and those they look to for advice,” he says. “This principle of confidentiality of presidential conversations is at stake in the question of these tapes. I must and I shall oppose any efforts to destroy this principle.”
'Hard and Tough' Politics - Watergate has come to encompass more than just a burglary, Nixon says, but has brought up issues of partisan politics, “enemy lists” (see June 27, 1973), and even threats to national security. Nixon has always run “hard and tough” political campaigns, but has never stepped outside the law and “the limits of decency” in doing so. “To the extent that these things were done in the 1972 campaign, they were serious abuses, and I deplore them,” he says. The “few overzealous people” involved in the Watergate burglary should not reflect on his administration or the political process as a whole. He will “ensure that one of the results of Watergate is a new level of political decency and integrity in America—in which what has been wrong in our politics no longer corrupts or demeans what is right in our politics.”
Legal Wiretapping to Protect the Nation - The measures he has taken to protect the security of the nation have all been within the law and with the intention of protecting the government from possible subversion and even overthrow, he asserts. The wiretaps he authorized had been legal, he says, until the 1972 decision by the Supreme Court that rejected such wiretaps as unlawful (see June 19, 1972). Until then, Nixon says, he—like his predecessors—had implemented such wiretaps “to protect the national security in the public interest.” Since the Supreme Court decision, he says, he has stopped all such surveillance efforts. But the law must be mindful of “tying the president’s hands in a way that would risk sacrificing our security, and with it all our liberties.” He will continue to “protect the security of this nation… by constitutional means, in ways that will not threaten [American] freedom.”
The Fault of the Radicals - He blames the antiwar and civil rights movements of the 1960s as encouraging “individuals and groups… to take the law into their own hands,” often with the praise and support from the media and even from “some of our pulpits as evidence of a new idealism. Those of us who insisted on the old restraints, who warned of the overriding importance of operating within the law and by the rules, were accused of being reactionaries.” In the wake of this radical, anti-government atmosphere, the country was plagued by “a rising spiral of violence and fear, of riots and arson and bombings, all in the name of peace and in the name of justice. Political discussion turned into savage debate. Free speech was brutally suppressed as hecklers shouted down or even physically assaulted those with whom they disagreed. Serious people raised serious questions about whether we could survive as a free democracy.” That attitude permeated political campaigns, to the extent that “some persons in 1972 adopted the morality that they themselves had tightly condemned and committed acts that have no place in our political system… who mistakenly thought their cause justified their violations of the law.”
Looking Forward - It is time to put Watergate behind us, Nixon says, to abandon this “continued, backward-looking obsession with Watergate” and stop “neglect[ing] matters of far greater importance to all of the American people.… The time has come to turn Watergate over to the courts, where the questions of guilt or innocence belong. Haldeman, from June 20, 1972 (see July 13-16, 1973). Nixon lawyer Fred Buzhardt says he has no explanation for “the phenomenon.” Nixon’s secretary, Rose Mary Woods, denies any deliberate erasure. But electronics experts will eventually find that the tape has been deliberately erased at least five separate times. White House chief of staff Alexander Haig will blame “some sinister force” for the erasure.
Watergate Discussed - Former Watergate special prosecutor Archibald Cox’s subpoena of the tape (see July 23-26, 1973) says that “there is every reason to infer that the meeting included discussion of the Watergate incident.” That supposition is bolstered by previous testimony from former White House aide John Ehrlichman (see July 24, 1973). Watergate prosecutor Leon Jaworski says he is considering having all the remaining Watergate tapes placed under guard to prevent any further tampering. [Washington Post, 11/22/1973; Gerald R. Three Suspects - Evidence later shows that only three people could have made the erasure: Woods; Stephen Bull, Nixon’s assistant; and Nixon himself. [Reston, 2007, pp. 33]
Washington Post Learns of Gap - Washington Post reporter Bob Woodward learned of “deliberate erasures” in the first week of November from his FBI source, W. Mark Felt (see May 31, 2005). White House sources confirmed that the tapes were often of poor quality, and that some inadvertent gaps existed, but, as press secretary Ron Ziegler tells Woodward’s colleague Carl Bernstein, to say that those gaps were deliberate would be “inaccurate.” When the deliberate gap is reported, Ziegler calls Bernstein to say that he did not know about the gap beforehand. Neither Bernstein nor Woodward doubt Ziegler—by this time, it is obvious that Nixon’s paranoia and penchant for secrecy extends even to the most trusted members of his staff. Symbolic - In 2005, Woodward will write: “The missing 18 1/2-minute gap soon becomes a symbol for Nixon’s entire Watergate problem. The truth had been deleted. The truth was missing.” [Woodward, 2005, pp. 103]

In the aftermath of the Watergate scandal (see August 8, 1974), amendments to the Federal Election Campaign Act (FECA—see February 7, 1972) provide the option for full public financing for presidential general elections, matching funds for presidential primaries, and public expenditures for presidential nominating conventions. The amendments also set spending limits on presidential primaries and general elections as well as for House and Senate primaries. The amendments give some enforcement provisions to previously enacted spending limits on House and Senate general elections. They set strict spending guidelines: for presidential campaigns, each candidate is limited to $10 million for primaries, $20 million for general elections, and $2 million for nominating conventions; Senatorial candidates are limited to $100,000 or eight cents per eligible voter, whichever is higher, for primaries, and higher limits of $150,000 or 12 cents per voter for general elections; House candidates are limited to $70,000 each for primaries and general elections. Loans are treated as contributions. The amendments create an individual contribution limit of $1,000 to a candidate per election and a PAC (political action committee) contribution limit of $5,000 to a candidate per election (this provision will trigger what the Center for Responsive Politics will call a “PAC boom” in the late 1970s). The total aggregate contributions from an individual are set at $25,000 per year. Candidates face further restrictions on how much personal wealth they can contribute to their own campaign. The 1940 ban on contributions from government employees and contract workers (see 1940) is repealed, as are the 1971 limitations on media spending. Perhaps most importantly, the amendments create the Federal Election Commission (FEC) to oversee and administer campaign law. (Before, enforcement and oversight responsibilities were spread among the Clerk of the House, the Secretary of the Senate, and the Comptroller General of the United States General Accounting Office (GAO), with the Justice Department responsible for prosecuting violators (see 1967).) The FEC is led by a board of six commissioners, with Congress appointing four of those commissioners and the president appointing two more. The Secretary of the Senate and the Clerk of the House are designated nonvoting, exofficio commissioners. Transcripts Prove His Innocence, Nixon Claims - A summary of the tapes, written by White House officials, says that the transcripts prove Nixon’s innocence. “In all of the thousands of words spoken,” the summary says, “even though they often are unclear and ambiguous, not once does it appear that the president of the United States was engaged in a criminal plot to obstruct justice.” [Washington Post, 5/1/1974] Shortly after the release of the transcripts, Nixon appears on television with a pile of looseleaf notebooks—the transcripts, which he says he has personally compiled—and says: “In these transcripts, portions not relevant to my knowledge or actions with regard to Watergate are not included, but everything that is relevant is included—the rough as well as the smooth—the strategy sessions, the exploration of alternatives, the weighing of human and political costs. As far as what the president personally knew and did with regard to Watergate and the cover-up is concerned, these materials—together with those already made available—will tell it all.… I want there to be no question remaining about the fact that the president has nothing to hide in this matter.” [White House, 4/29/1974; White House, 4/29/1974; White House, 4/29/1974; White House, 4/29/1974; Washington Post, 2007] “As far as the president’s role with regard to Watergate is concerned,” Nixon claims, “the entire story is there.” [Reeves, 2001, pp. 608] He rails against the idea of impeaching him (see February 6, 1974), saying that the charges are based on “[r]umor, gossip, innuendo, [and] accounts from unnamed sources,” and implicitly accuses former White House counsel John Dean of lying about his involvement in the Watergate cover-up (see April 6-20, 1973). The 18 ½ minute erasure on one of the key tape recordings (see November 21, 1973) is “a mystery” to him, Nixon asserts. The nation must move past Watergate to deal with more serious matters, he says. Reaction Divided - Reaction on Congress is divided largely along party lines. House Minority Leader John Rhodes (R-AZ) says the transcripts show Nixon is “in substantial compliance” with a Judiciary Committee subpoena. Speaker of the House Carl Albert (D-FL) has a different view: “Why substitute other evidence when the direct evidence [the actual tapes] is available?” [Washington Post, 5/1/1974]
Transcripts Heavily Edited, Doctored - It quickly becomes evident that the transcripts have been heavily edited and altered, both to clean up Nixon’s language and to cloak the details of the events documented in the tapes. Only 11 of the 64 conversations cited in the subpoenas are present, and those have been doctored. The term “expletive deleted” quickly enters the political and popular lexicon, and even with much of the profanity and ethnic slurs deleted, the impression given by the transcripts is not popular with the American people; in the words of reporter Mike Feinsilber, the transcripts show Nixon “as a vengeful schemer—rambling, undisciplined, mean-spirited and bigoted.” Even the edited transcripts document Nixon participating in discussions about raising blackmail money and “laundering” payments, offering clemency or parole to convicted Watergate figures, discussing how to handle perjury or obstruction of justice charges, and debating how best to use the term “national security” to advance his own personal and political agendas. In one conversation, Dean says that one of their biggest problems is that they are not “pros” at the kinds of activities they are engaging in: “This is the sort of thing Mafia people can do.” Nixon replies: “That’s right.… Maybe it takes a gang to do that.” The Judiciary Committee immediately joins the special prosecutor in demanding the actual tapes. The US Supreme Court rules in Richardson v. Ramirez that states may deny convicted felons the right to vote. The case originated when felons who had completed their sentences sued the California secretary of state and election officials, challenging a state constitutional provision and related statutes that permanently denied them the right to vote unless their rights were restored, on an individual basis, by court order or executive pardon. The burden is generally on the state to show a “compelling state interest” in denying a citizen the right to vote. The plaintiffs argued that California had no compelling state interest in denying them their right to vote. The plaintiffs won their case in California’s Supreme Court. However, the US Supreme Court rules that a state does not have to prove that its felony disfranchisement laws serve a compelling state interest. The Court finds that the Fourteenth Amendment exempts felony disenfranchisement laws from the burden placed on states in voting rights matters. [American Civil Liberties Union, 2012; RICHARDSON v. RAMIREZ, 418 US 24 (1974), 2012] The Court writes: “[I]t is not for us to choose one set of values over the other. If respondents are correct, and the view which they advocate is indeed the more enlightened one, presumably the people of the State of California will ultimately come around to the view. The Justice Department’s Office of Planning and Evaluation (OPE) submits a report on the role and actions of the FBI in the Watergate investigations. The report finds that, even with the attempts of former Attorneys General John Mitchell and Richard Kleindienst, White House aides John Dean and Jeb Magruder, and others to “mislead and thwart the Bureau’s legitimate line of inquiry,” and the “contrived covers” used to direct attention away from the White House, the FBI investigation was “the ultimate key to the solution of not only the Watergate break-in (see 2:30 a.m.June 17, 1972) but the cover itself.” The report continues: “There can be no question that the actions of former Attorneys General Mitchell and Kleindienst served to thwart and/or impede the Bureau’s investigative effort. The actions of John W. Dean at the White House and Jeb S. Magruder at the Committee to Re-elect the President were purposefully designed to mislead and thwart the Bureau’s legitimate line of inquiry. At every stage of the investigation there were contrived covers placed in order to mislead the investigators.” The OPE notes the following problems in the investigation, and provides explanations of some:
bullet Providing information concerning ongoing investigations to the White House, and allowing Dean to actually sit in on interviews of White House personnel (see June 22, 1972).
bullet Failing to interview key members of CREEP, the Nixon re-election campaign organization, as well as allowing CREEP attorneys to sit in on interviews of CREEP employees and allowing those attorneys access to FBI investigative materials. The report says that the investigation initially focused on James McCord and E. Howard Hunt, and interviewed CREEP officials tied directly to them. The net was widened later on. However, the report acknowledges that many CREEP employees undoubtedly lied to FBI investigators, “most notably John Mitchell, Jeb Magruder, Bart Porter, Sally Harmony, and Maurice Stans.” Porter and Magruder in particular “lied most convincingly.” Another CREEP employee, Robert Reisner (Magruder’s assistant), was not interviewed because Reisner successfully hid from FBI investigators. The FBI believes it was Reisner who cleaned out the “Operation Gemstone” files from Magruder’s office (see January 29, 1972 and September 29, 1972). Numerous other financial and other files were also destroyed after being requested by the FBI, most notably Alfred Baldwin’s surveillance tapes and logs from the Democratic offices in the Watergate (see May 29, 1972). Many of these files were destroyed by G. Gordon Liddy. “It is apparent that most [CREEP] people in the summer of 1972 were quite willing to lie and/or tell us considerably less than the full truth,” the report notes.
bullet An untenable delay in searching and securing Watergate burglar E. Howard Hunt’s desk in the White House, putting the contents of that desk at risk of being removed, and the “[a]lleged activities by former Acting Director [L. Patrick] Gray to limit, contain, or obstruct FBI investigation of Watergate” (see June 22, 1972). Gray is known to have destroyed materials from Hunt’s desk given to him by Dean, and is known to have extensively interfered with the FBI’s investigation (see June 28-29, 1972 and Late December 1972). The report notes that while it cannot find specific evidence that Gray broke any laws in his attempts to impede the FBI’s investigation into the Watergate conspiracy, it is clear that Gray cooperated with the White House, specifically through Dean, to ensure that the White House was always aware of what avenues of investigation were being pursued. The OPE says that Gray’s destruction of files from Hunt’s safe did not necessarily impede the FBI’s investigation, because it has no way of knowing what was in those files. The report says that it is unfortunate that “many people make no distinction between the FBI’s actions and Mr. Gray’s actions.”
bullet Failure to interview key individuals with knowledge of the suspicious monies found in the burglars’ bank accounts.
bullet Failing to secure and execute search warrants for the burglars’ homes, automobiles, and offices. The OPE says that many of those issuing this criticism “should know better,” and claims that the FBI agents involved did their level best to obtain search warrants within the bounds of the law. The report notes that after the burglary, the assistant district attorney prosecuting the case, Earl Silbert, did not believe there was probable cause to search burglar James McCord’s home or office until after July 10, 1972, when Baldwin told the FBI that he had taken surveillance equipment to McCord’s home (see June 17, 1972). Even then, Silbert decided that because of the amount of time—23 days—that had expired, a search warrant would have been pointless.
bullet Failing to identify and interview a number of people listed in the burglars’ address books. The OPE report notes that the decision to interview far less than half of the names in the books was made by FBI agents in the Miami field office, and due to the “fast moving extensive investigation which was then being conducted,” the decision to only track down a selected few from the books was right and proper. The report notes that subsequent interviews by reporters of some of the people in the address books elicited no new information. The report also notes that Gray refused to countenance interviews of the remaining subjects in the address book while the trial of the seven burglars (see January 8-11, 1973) was underway.
bullet Failing to find and remove a surveillance device from the Democratic National Committee headquarters (see September 13, 1972). The OPE calls this failure “inexplicable.”
bullet Failure to thoroughly investigate CREEP agent Donald Segretti (see June 27, 1971, and Beyond) and other CREEP operatives. The OPE finds that because Segretti was initially uncooperative with FBI investigators, and because an “extensive investigation” turned up nothing to connect Segretti with the Watergate conspiracy, the agents chose not to continue looking into Segretti’s actions. Only after press reports named Segretti as part of a massive, White House-directed attempt to subvert the elections process (see October 7, 1972) did the FBI discuss reopening its investigation into Segretti. After reviewing its information, the FBI decided again not to bother with Segretti. The OPE finds that the decision was valid, because Segretti had not apparently broken any federal laws, and the FBI does not conduct violations of election laws unless specifically requested to do so by the Justice Department. The report also says that politics were a concern: by opening a large, extensive investigation into the Nixon campaign’s “dirty tricks,” that investigation might have impacted the upcoming presidential elections.
bullet Media leaks from within the FBI concerning key details about the investigation (see May 31, 2005). The report finds no evidence to pin the blame for the leaks on any particular individual. The report notes that New York Times reporter John Crewdson seemed to have unwarranted access to FBI documents and files, but says it has turned that matter over to another agency inside the bureau.
bullet Failing to interview, or adequately interview, key White House officials such as H. R. Haldeman, Charles Colson, Dwight Chapin, and others. The report justifies the decision not to interview Haldeman because the FBI had no information that Haldeman had any knowledge of, or involvement in, the burglary itself.
bullet “Alleged attempt on part of Department of Justice officials to limit, contain, or obstruct FBI investigation.” The report is particularly critical of Kleindienst’s concealment of his contact with Liddy about the burglary (see June 17, 1972).
bullet “Alleged attempt by CIA officials to interfere, contain, or impede FBI Watergate investigation.” The report notes that during the Senate Watergate Committee hearings, Republican co-chairman Howard Baker (R-TN) tried repeatedly to assert that the CIA was behind the burglary. The report calls Baker’s theory “intriguing” but says no evidence of CIA involvement on any operational level was ever found. The report notes that there is still no explanation for the discussions regarding the CIA paying the burglars (see June 26-29, 1972), or the CIA’s involvement with Hunt before the burglary—loaning him cameras, providing him with materials for a disguise, and helping Hunt get film from the first burglary developed. According to the report, Gray stopped the FBI from pursuing these leads. The FBI report says that the CIA involvement apparently had nothing to do with the Watergate burglary, but was more in support of Hunt’s activities with the Ellsberg break-in (see September 9, 1971).
bullet “Alleged activities on part of White House officials to limit, contain, or obstruct FBI Watergate investigation (Dean, Haldeman, Ehrlichman, Colson, et cetera).” The report notes, “There is absolutely no question but that the president’s most senior associates at the White House conspired with great success for nine months to obstruct our investigation.” The report says it was “common knowledge” throughout the investigation that the White House was paying only “lip service” to investigators’ requests for honest, complete answers; the report cites Dean as a specific offender. The Supreme Court, in the case of United States v. Nixon, votes 8-0 to uphold the subpoena of special prosecutor Leon Jaworski demanding the Watergate tapes for use in the trial of Nixon’s former aides (see March 1, 1974). (William Rehnquist, a Nixon appointee, recused himself from deliberations.) The Court rules, in an opinion written by Chief Justice Warren Burger, that Nixon’s claim of “executive privilege” authorizing him to keep the tapes to himself does not apply, and that his lawyers’ claim that neither the courts nor the special prosecutor have the authority to review the claim also has no weight. Jaworski and one of his senior staffers, Philip Lacovara, argued the case against an array of lawyers for Nixon headed by James St. Clair. Alexander Haig.Alexander Haig. [Source: Brooks Institute]President Richard Nixon`s chief of staff Alexander Haig pays an urgent call on Vice President Gerald Ford to discuss the terms under which Nixon will resign (see August 8, 1974). Haig gives Ford a handwritten list of what White House counsel Fred Buzhardt, the author of the list, calls “permutations for the option of resignation.” The idea is for Nixon to agree to resign in return for Ford’s agreement to pardon Nixon for any crimes Nixon may have committed while president. Ford listens to Haig but does not agree to any terms. The next day, after learning of the meeting, Ford’s own counsel, Robert Hartmann, is outraged that Ford did not just throw Haig out of his office. With fellow counsel John Marsh, Hartmann demands that Ford call Haig and state unequivocally, for the record, and in front of witnesses that Ford has made no such agreements. Haig considers Hartmann essentially incompetent, and Hartmann views Haig as a power-hungry “assh_le.” The subsequent tensions between Haig, one of the Nixon holdovers in Ford’s presidency, and Ford’s staff will shape future events in the Ford administration. In part to counteract Haig’s influence, Ford will name former NATO ambassador and Nixon aide Donald Rumsfeld as the head of his transition team. Rumsfeld will in turn name former Wyoming congressman and current investment executive Dick Cheney as his deputy; Cheney has lectured his clients that Watergate was never a criminal conspiracy, but merely a power struggle between the White House and Congress. Betty Ford.Betty Ford. [Source: Wally McNamee / Corbis]Despite President Ford’s insistence that he is not considering a pardon for former President Richard Nixon (see September 5-6, 1974), and Ford’s own denials in his 1976 memoir A Time to Heal, Ford tells his lawyer, Robert Hartmann, that he and his wife Betty have decided that if Nixon resigns, Ford will likely pardon him for any Watergate crimes. “We felt we were ready,” Ford tells Hartmann. “This just has to stop; it’s tearing the country to pieces. I decided to go ahead and get it over with, so I called [Nixon’s chief of staff] Al Haig and told them they should do whatever they decided to do; it was all right with me” (see August 1-2, 1974). This is not the last time stories will conflict over Ford’s decision on whether to pardon Nixon (see August 30, 1974 and September 5-6, 1974). [Werth, 2006, pp. 204]

Nixon chief of staff Alexander Haig has Watergate special prosecutor Leon Jaworski to lunch at Haig’s home. Haig wants to personally inform Jaworski that President Nixon will resign (see August 8, 1974), that Nixon’s papers, and the secret recordings he made while president, will be shipped to his California home, and that Jaworski will have access to those documents as needed. “There’s no hanky-panky involved,” Haig assures Jaworski, but then says: “I don’t mind telling you that I haven’t the slightest doubt that the tapes were screwed with. The ones with the gaps and other problems.” [Werth, 2006, pp. 31]
