In the wake of anti-war demonstrations and urban rioting in several US cities, the Pentagon establishes a set of civil disturbance plans designed to put down political protests and civil unrest. Conducted under the codename Operation Garden Plot, the new program significantly increases the role of the military in training for and intervening in social uprisings. The Pentagon develops contingency plans for every city considered to have potential for uprisings by students, minorities, or labor unions. Each area of the country follows a subplan of Operation Garden Plot. Operation Cable Splicer, for instance, covers the states of California, Oregon, Washington, and Arizona (see May 1968, February 10, 1969, March 1969, and May 1970). Each region will conduct exercises and war games to practice and develop its individual plans. To oversee the operations, the Pentagon establishes the Directorate of Civil Disturbance and Planning Operations. California Governor Ronald Reagan, along with a variety of other local, state, and federal officials, kicks off a regional exercise known as Cable Splicer II at the Governor’s Orientation Conference. Operation Cable Splicer is part of Operation Garden Plot, a program established by the Pentagon to monitor and put down civil unrest (see Winter 1967-1968). Cable Splicer is a subplan designed to cover the states of California, Washington, Oregon, and Arizona. Governor Reagan addresses an audience of approximately 500 Army officials and troops, local and state police officers, military intelligence personnel, private executives, and state legislators. “You know,” he says, “there are people in the state who, if they could see this gathering right now and my presence here, would decide that their worst fears and convictions had been realized—I was planning a military takeover.” According to New Times magazine, Chief Deputy Attorney General Charles O’Brien speaks bluntly about constitutional rights, “arguing at one point that if the Constitution prevents the police from gathering political intelligence, then the Constitution goes too far.” O’Brien continues: “This is a revolution, and anything goes. A civil disturbance anywhere in this state is an attack on the state itself.” Deputy Attorney General Buck Compton argues that “free speech, civil rights, [and] rights to assembly” have all become “clich├ęs.” Congressman Clair Burgener attends the conference, but is only vaguely aware of the scope of the upcoming exercise and emergency plans. He is later surprised to learn of the conference’s true nature. He will later tell New Times magazine, “If this was going on in this spirit, they were certainly pulling the wool over the eyes of the invited guests.” After reviewing the plans, he will say: “Well, I’ll be damned! A large exercise, codenamed Cable Splicer II, is conducted in California to test and develop the ability of local, state, and federal officials to deal with political protests and urban rioting. Operation Cable Splicer is a regional subplan of the Pentagon’s Operation Garden Plot (see Winter 1967-1968). A month earlier, Governor Ronald Reagan and other officials ceremoniously kicked off the war game (see February 10, 1969). The exercise, which simulates a variety of civil disturbances, is spread across 23 political jurisdictions and includes National Guard officers, Army advisers, senior police and sheriff officers, and private executives. According to New Times magazine, “over 1,200 preplanned intelligence reports on supposedly imaginary events, people, and organizations” are pasted on index cards and handed to the participants to help “generate the make-believe war.” The magazine will later report: “The players listen to a special intelligence summary, learning the background of the civil disturbance that has led to the current ‘emergency.’ At that point, the ‘controllers’—usually senior National Guard officers and their Army advisers—begin play, feeding the IBM-card preplanned intelligence reports of dissident activity to the players. Seated at rows of desks dotted with telephones, facing a ‘situation map’ of their community, the players respond to the unfolding scenario.”
Storyline - In the first phase of the exercise, an arrest and shooting “provoke crowd unrest and threats against public officials.” Fourteen simulated hours later, rioters attack a police car and injure an officer. A member of a minority group is killed and two others are wounded. There are threats of retaliation against police officers. Mock intelligence reports suggest widespread rioting is likely, as dozens of apparent radicals are flown in on a “chartered flight” and picked up at the airport by 20 separate vehicles. The second phase of the exercise begins with “the ambush of several police cars, the attempted assassination of the mayor, the bombing of local armories, the destruction of vehicles and ammunition stocks, and the gathering of thousands of people in the streets.” The exercise participants call in police from outside jurisdictions and cities, but they are unsuccessful at quelling the violence. In the third phase of the exercise, according to New Times, “intelligence reports pouring into the Emergency Operations Center disclose more fire bombings, attempted assassinations of public officials, hoarding of water in certain areas, and sniping of fire trucks. The streets remain filled with thousands of people, and the National Guard is called to active duty.” As the crowd turns increasingly violent, the Army is called upon to take over for the National Guard. The crowd is finally dispersed, although the details of exactly how are unknown. “At their disposal,” New Times reports, “there are heavy artillery, armor, chemical and psychological warfare teams, and tactical air support.” The third phase concludes with a few “loose militants” unable to gain popular influence. President Nixon signs Executive Order 11490, updating the nation’s secretive Continuity of Government (COG) plans. Under the vague title, “Assigning Emergency Preparedness Functions to Federal Departments and Agencies,” the order directs government leaders to ensure the continuation of “essential functions” in the event of a crisis. The order grants a wide range of emergency powers to the executive branch. It directs department heads to have emergency plans for succession of office, predelegation of authority, safekeeping of records, alternative command facilities, and other “emergency action steps.” The plans are to be overseen by the Office of Emergency Preparedness (OEP). Conservative writer Howard J. Ruff will express concern over the scope of the order. “The only thing standing between us and a dictatorship,” Ruff writes, “is the good character of the president and the lack of a crisis severe enough that the public would stand still for it.” In 1984, Attorney General William Smith will object to attempts by the Reagan administration to expand the powers granted in the order (see August 2, 1984). President Reagan will officially update the plans in 1988, replacing and expanding Executive Order 11490 with Executive Order 12656 (see November 18, 1988). Louis O. Giuffrida, a colonel in the US Army who will later head the Federal Emergency Management Agency (FEMA) under President Reagan (see May 18, 1981), writes a paper while at the US Army War College advocating martial law in the event of a militant uprising by African Americans. Participants in a California civil disturbance exercise, codenamed Cable Splicer III, hold an “After Action Conference” to discuss the results. The participants, which include Army officials, local police officers, and private executives, spend much of the conference pronouncing their disgust for leftists and other activists. According to New Times magazine, speakers at the conference condemn “university administrators who demur at giving the police free rein on the campuses; parents of ‘would-be revolutionaries’ who support their children; and legislators who investigate police actions.” Political demonstrators are referred to as “guerrillas,” “modern day barbarians,” “Brown Shirts,” “kooks,” and “VC.” Los Angeles Police Department Inspector John A. McAllister gives a lecture listing activities that “require police action,” including “loud, boisterous, or obscene” behavior on beaches, “love-in type gatherings in parks where in large numbers they freak out,” disruptions by “noisy and sometimes violent dissidents,” peace marches and rock festivals where “violence is commonplace and sex is unrestrained,” and “campus disruptions—which in fact are nothing more than mini-revolutions.” [New Times, 11/28/1975]

California Governor Ronald Reagan establishes the California Specialized Training Institute (CSTI) to oversee disaster training and exercises for the state. The CSTI, which will serve as a branch of the governor’s Office of Emergency Services, will prepare emergency personnel for a variety of scenarios ranging from terrorist attacks, to environmental hazards, to civil disturbances. The creation of the institute was recommended by participants in the exercises Cable Splicer II and Cable Splicer III (see March 1969 and May 1970). The facility, built with a $425,000 grant from the Federal Law Enforcement Assistance Administration, is meant to duplicate the functions of the Senior Officers Civil Disturbance Course (SEADOC) in Fort Gordon, Georgia. The CSTI will be criticized for training police officers to use military-style tactics in domestic law enforcement situations. It will teach a controversial program known as the Civil Emergency Management Course (see September 1971). Reagan appoints Louis O. Giuffrida, a US Army colonel, to head the CSTI. A year earlier, Giuffrida wrote a paper advocating martial law and the emergency roundup of 21 million “American Negroes” to “assembly centers or relocation camps” in the event of a militant uprising by African Americans (see 1970). Giuffrida will later be appointed to head the Federal Emergency Management Agency (FEMA) during Reagan’s presidency (see May 18, 1981). The Federal Emergency Management Agency (FEMA), known best as a relief agency for victims of natural disasters, is secretly dedicated to the highly classified Continuity of Government (COG) program, which is meant to ensure the survival of the federal government in times of national emergency. Upon its establishment, FEMA absorbs the Defense Civil Preparedness Agency (DCPA) and the Federal Preparedness Agency (FPA), which were previously responsible for the top-secret plans (see April 1, 1979). During the 1980s and into the early 1990s, FEMA’s budget and workforce are overwhelming geared towards the COG program (see 1982-1991 and February 1993). FEMA remains in charge of overseeing the government’s continuity plans up to present day. The National Program Office (NPO), which is responsible for the highly classified Continuity of Government program, establishes a secret line of presidential succession for certain “narrowly defined” emergency situations. According to the traditional legal line of succession, should the president of the United States be killed or incapacitated, he is to be replaced by the vice president, followed by the Speaker of the House of Representatives, then by the President Pro Tempore of the Senate, then each cabinet member from the Secretary of State down. The alternative succession plan developed by the NPO, known officially as the Presidential Successor Support System, or “PS cubed,” would suspend these traditional rules and allow a small group of officials to appoint a new government. A source with knowledge of the plan says it would “suspend that natural succession and these individuals would have the right to appoint, virtually appoint, a new government.” The program, according to author James Mann, calls for “setting aside the legal rules of presidential succession in some circumstances, in favor of a secret procedure for putting in place a new ‘president’ and his staff.” The idea is to “concentrate on speed, to preserve ‘continuity of government,’ and to avoid cumbersome procedures; the speaker of the House, the president pro tempore of the Senate, and the rest of Congress would play a greatly diminished role.” The alternative succession plan allows the presidency, the vice presidency, and each cabinet position to be filled by individuals from both inside and outside the active government. In 1991, CNN will list the names of several people that may assume power should the plan be put into action, including Dick Cheney, Howard Baker, Richard Helms, Jeane Kirkpatrick, James Schlesinger, Edwin Meese, Dick Thornburgh, and Tip O’Neill. Some participants say the alternative succession plan is absolutely necessary to ensure the survival of the federal government, but others argue the secrecy of the program undermines its credibility. “If no one knows in advance what the line of succession is meant to be,” says a constitutional scholar from Duke University, “then almost by hypothesis no one will have any reason to believe that those who claim to be exercising that authority in fact possess it.” [CNN Special Assignment, 11/17/1991; Atlantic Monthly, 3/2004]

Presently, Cheney is working as a Republican congressman, while Rumsfeld is head of the pharmaceutical company G. D. Searle. At least once per year, they both leave their day jobs for periods of three or four days. They head to Andrews Air Force Base, near Washington, DC, and along with 40 to 60 federal officials and one member of the Reagan Cabinet are taken to a remote location within the US, such as an underground bunker. While they are gone, none of their work colleagues, or even their wives, knows where they are. They are participating in detailed planning exercises for keeping government running during and after a nuclear war with the Soviet Union.
Unconstitutional 'Continuity of Government' - This highly secret “Continuity of Government” (COG) program is known as Project 908. The idea is that if the US were under a nuclear attack, three teams would be sent from Washington to separate locations around the US to prepare to take leadership of the country. If somehow one team was located and hit with a nuclear weapon, the second or third team could take its place. Each of the three teams includes representatives from the State Department, Defense Department, CIA, and various domestic-policy agencies. The program is run by a new government agency called the National Program Office. Based in the Washington area, it has a budget of hundreds of million dollars a year, which grows to $1 billion per year by the end of Reagan’s first term in office. Within the National Security Council, the “action officer” involved in the COG program is Oliver North, who is a key figure in the mid-1980s Iran-Contra scandal. Reagan’s Vice President, George H. W. Bush, also supervises some of the program’s efforts. As well as Cheney and Rumsfeld, other known figures involved in the COG exercises include Kenneth Duberstein, who serves for a time as President Reagan’s chief of staff, and future CIA Director James Woolsey. Another regular participant is Richard Clarke, who on 9/11 will be the White House chief of counterterrorism (see (1984-2004)). The program, though, is extraconstitutional, as it establishes a process for designating a new US president that is nowhere authorized in the US Constitution or federal law. After George H. W. Bush is elected president in 1988 and the effective end of the Soviet Union in 1989, the exercises continue. They will go on after Bill Clinton is elected president, but will then be based around the threat posed by terrorists, rather than the Soviet Union (see 1992-2000). According to journalist James Mann, the participation of Rumsfeld and Cheney in these exercises demonstrates a broader truth about them: “Over three decades, from the Ford administration onward, even when they were out of the executive branch of government, they were never too far away; they stayed in touch with its defense, military, and intelligence officials and were regularly called upon by those officials. No Role for Congress - According to one participant, “One of the awkward questions we faced was whether to reconstitute Congress after a nuclear attack. It was decided that no, it would be easier to operate without them.” Thus the decision is made to abandon the Constitutional framework of the nation’s government if this plan is ever activated. Reactivated after 9/11 - The plan they rehearse for in the COG exercises will be activated, supposedly for the first time, in the hours during and after the 9/11 attacks (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). Louis O. Giuffrida is confirmed by the Senate to become the next director of the Federal Emergency Management Agency (FEMA). Guiffrida, who was recently promoted to the rank of general in the California National Guard, served under President Reagan when Reagan was governor of California. Giuffrida headed the California Specialized Training Institute (CSTI) (see 1971) and was an “adviser on terrorism, emergency management, and other special topics.” According to Reagan, Giuffrida has a “lengthy career as a military and civilian expert in crime prevention and investigation, industrial defense, physical security, civil disturbances and disasters, confinement, and rehabilitation responsibilities.” [Nomination of Louis O. The National Preparedness Directorate within the Federal Emergency Management Agency (FEMA), which is responsible for overseeing parts the highly classified Continuity of Government (COG) program, develops and maintains a high-tech fleet of mobile command centers, known as Mobile Emergency Response Support (MERS) units. The MERS vehicles, crafted out of 18-wheel tractor-trailer trucks, are meant to provide federal leaders with the ability to not only escape a nuclear attack, but also monitor information and communicate with the rest of the government while on the move. The MERS units cost billions of dollars to develop and are packed with sophisticated technology. According to Cox News Service: “Sensitive radio, telephone, and satellite gear—much of it classified—is stored in custom-built trucks that resemble mobile bank vaults.… The mobile units can operate for a month without support. They include generators capable of powering a three-story airport terminal and a fuel tanker that can suck diesel fuel from whatever service stations survive the nuclear blast.” One truck carries a pop-up satellite dish and weighs 24 tons. Early models, however, are inundated with problems. When the first two MERS prototypes are tested in 1984, one gets wedged beneath a highway overpass because it is too tall, while the other causes a road to collapse because it is too heavy. There are also technical flaws. The communication system at the heart of the Continuity of Government program does not function properly from late 1985 until at least December 1990 (see Late 1985 and December 1990). Despite the complications, FEMA eventually constructs 300 MERS vehicles and stations them at secure facilities in Washington State, Massachusetts, Denver, southern Georgia, and rural Texas. Most of the MERS vehicles are used rarely, if ever. “Billions of dollars were spent on such equipment, much of which is now gathering dust in Army depots,” the New York Times reports in 1994. John Brinkeroff, deputy for national preparedness programs at the Federal Emergency Management Agency (FEMA), outlines plans for implementing martial law in the event of a national emergency. In a memorandum later obtained by the Miami Herald, Brinkeroff describes how FEMA and the military would take over the country in the event of a crisis. According to the Herald, the plans include “suspension of the Constitution, turning control of the United States over to FEMA, appointment of military commanders to run state and local governments, and declaration of martial law during a national crisis.” Although the term “national crisis” is not defined, the Herald will later report that it is understood to mean anything from nuclear war to “violent and widespread internal dissent or national opposition against a military invasion abroad.” A source will tell the Herald the contingency plan is authorized by an “executive order or legislative package that [President] Reagan would sign and hold within the NSC [National Security Council] until a severe crisis arose.” This may refer to emergency legislation drafted by the Reagan administration to amend the 1950 Defense Resources Act (see September 25, 1984) and proposed updates to Executive Order 11490 (see August 2, 1984). The Brinkeroff memo resembles a paper written in 1970 by the current head of FEMA, Louis O. Giuffrida, in which he advocated the roundup and transfer of at least 21 million “American Negroes” to “assembly centers or relocation camps” in the event of an emergency (see 1970). In a letter to National Security Adviser Robert McFarlane, Attorney General William French Smith strongly objects to martial law plans developed by the National Security Council and the Federal Emergency Management Agency (FEMA). Smith learns the full extent of the plans upon reviewing a proposal by the Reagan administration to change Executive Order 11490 (see October 28, 1969). The Reagan administration is holding the drafted changes, along with standby legislation to amend the 1950 Defense Resources Act (see September 25, 1984), in preparation for any emergency that may require a military-style takeover of the nation’s resources and population. The plans cover a range of crisis situations, including a nuclear attack, natural disasters, and civil unrest. Smith writes: “I believe that the draft executive order raises serious substantive and public policy issues that should be further addressed before this proposal is submitted to the president. In short I believe that the role assigned to the Federal Emergency Management Agency (FEMA) on the revised executive order exceeds its proper function as a coordinating agency for emergency preparedness.” Smith continues: “This department and others have repeatedly raised serious policy and legal objections to the creation of an ‘emergency czar’ role for FEMA. Specific policy concerns regarding recent FEMA initiatives include the abandonment of the principle of ‘several’ agency responsibility and the expansion of the definition of severe emergencies to encompass ‘routine’ domestic law enforcement emergencies. Legal objections relate to the absence of presidential or Congressional authorization for unilateral FEMA directives which seek to establish new federal government management structures or otherwise task cabinet departments and other federal agencies.” Despite the objections of the Justice Department, FEMA and the Reagan administration will not abandon the emergency doctrine. Before leaving office, Reagan will dramatically expand the government’s emergency powers and officially override Executive Order 11490 with Executive Order 12656 (see November 18, 1988). Nationally syndicated columnist Jack Anderson comments, “Since FEMA’s draft legislation is a standby proposal, it will not be offered to Congress ahead of time—when it could be thoroughly debated—but only in the event of a national emergency, when Congress would supposedly be panicked into voting for a dictatorship.” The bill covers a range of emergencies, including nuclear war, natural disasters, financial crises, and civil disturbances. It would grant the government the authority to ration goods and resources, take control of the nation’s manufacturing base, and require all citizens to work in “activities essential to the national health, safety, or interest.” The bill would outlaw striking by workers, and those refusing to work or caught lying about the availability of manpower would be heavily fined or thrown in jail. It would grant the government the authority to seize real estate and personal property considered “necessary for the national defense purpose.” Datamation magazine says the plans would lead to a military takeover of the computer industry. Officials from the National Program Office (NPO), responsible for the highly classified Continuity of Government program, fake an exercise in front of congressional leaders in order to cover up equipment failures. At a secret site near Great Falls, Montana, Speaker of the House Tip O’Neill (D-MA) and Senate Appropriations Committee Chairman Robert Byrd (D-WV) gather with other key officials to witness the first major test of a new post-nuclear communication system. The high-tech system, worth millions of dollars, is meant to provide government leaders with the ability to communicate during and after a nuclear war. Much of the equipment, however, was purchased from separate contractors and is technically incompatible. The multi-million dollar system does not function properly, but NPO officials rig the exercise, paving the way for additional funding. As one participant will later explain: “At one point information was supposed to be sent out, and even though lights were blinking and the wheels were turning, the message was being sent by payphone about a block and a half from the site where the exercise was taking place.… Millions of dollars worth of equipment failed to function correctly and 25 or 50 cents worth of change and a pay telephone got the message through.” The visiting congressmen, who are responsible for allocating funds for the project, are fooled into thinking the system is fully functional. Money will continue to flow into the shoddy equipment for years to come. Sources will tell CNN five years later that the system is still not working properly. “Very few people knew about the scam and because the program is so classified there was no one they could tell,” CNN will report in 1991. Fred Westerman, a retired Army intelligence veteran who now heads a government contracted security firm, reports several instances of waste, fraud, and abuse within the highly secretive Continuity of Government (COG) program, which is supposed to ensure the survival of the federal government during disaster situations. Longtime US Army intelligence officer Tom Golden, who is currently acting as a watchdog within the ultra-secretive Continuity of Government (COG) program (see January 1984), notifies the Army Inspector General’s Office of several instances of waste, fraud, and abuse within the highly classified COG project. Golden additionally speaks in confidence about his findings to the chief of the inspector general’s intelligence oversight division, Colonel Ned Bacheldor. Golden tells the Inspector General’s Office that contracts are being awarded based on personal relationships among military officials and company employees. He says government personnel have rotating careers at contracted companies and some are being hired at excessive rates for limited work. Golden says the multi-billion dollar communication system at the heart of the COG program does not function properly and is costing exorbitant amounts of money to fix, and alleges the problems are being covered up by military officials (see Late 1985 and December 1990). Golden reports a high-ranking officer within the COG program, Brigadier General Eugene Renzi, who was awarded a multimillion-dollar no-bid contract to the BETAC Corporation, which employed the general’s son. US News and World Report describes BETAC as a “consulting firm composed of former intelligence and communications specialists from the Pentagon.” Golden also notes the BETAC contract included $400-a-day consultant jobs for several COG officials, including one of Renzi’s aides. As a result of Golden’s report, two contracts will be found to be illegal and will be subsequently canceled. Renzi will also be reprimanded. The Army assures Golden his name will remain confidential, but his status as a whistleblower will be leaked weeks later by Bacheldor, who will soon leave the Inspector General’s Office to join the COG program. Golden will soon become the target of a retaliatory smear campaign led by members of the secret project, including Renzi and Bacheldor (see After July 1987). President Ronald Reagan signs Executive Order 12656, assigning a wide range of emergency responsibilities to a number of executive departments. The order calls for establishing emergency procedures that go far beyond the nation’s standard disaster relief plans. It offers a rare glimpse of the government’s plans for maintaining “continuity of government” in times of extreme national emergency. The order declares the national security of the country to be “dependent upon our ability to assure continuity of government, at every level, in any national security emergency situation,” which is defined as “any occurrence, including natural disaster, military attack, technological emergency, or other emergency, that seriously degrades or seriously threatens the national security of the United States.” The order instructs department leaders to establish various protocols for crisis situations, including rules for delegating authorities to emergency officials, establishing emergency operating facilities, protecting and allocating the nation’s essential resources, and managing terrorist attacks and civil disturbances. The plans are to be coordinated and managed by the National Security Council and the Federal Emergency Management Agency (FEMA). The presidential order suggests certain laws may have to be altered or expanded to carry out the plans. Although it encourages federal agencies to base the emergency protocols on “existing authorities, organizations, resources, and systems,” it also calls on government leaders to identify “areas where additional legal authorities may be needed to assist management and, consistent with applicable executive orders, take appropriate measures toward acquiring those authorities.” According to the executive order, the plans “will be designed and developed to provide maximum flexibility to the president.” Executive Order 12656 gives specific instructions to numerous federal departments:
bullet The Department of Justice is ordered to coordinate emergency “domestic law enforcement activities” and plan for situations “beyond the capabilities of state and local agencies.” The Justice Department is to establish plans for responding to “civil disturbances” and “terrorism incidents” within the US that “may result in a national security emergency or that occur during such an emergency.” The attorney general is to establish emergency “plans and procedures for the custody and protection of prisoners and the use of Federal penal and correctional institutions and resources.” The Department of Justice is also instructed to develop “national security emergency plans for regulation of immigration, regulation of nationals of enemy countries, and plans to implement laws for the control of persons entering or leaving the United States.” The attorney general is additionally instructed to assist the “heads of federal departments and agencies, state and local governments, and the private sector in the development of plans to physically protect essential resources and facilities.”
bullet The Department of Defense, acting through the Army, is to develop “overall plans for the management, control, and allocation of all usable waters from all sources within the jurisdiction of the United States.” The secretary of defense is to arrange, “through agreements with the heads of other federal departments and agencies, for the transfer of certain federal resources to the jurisdiction and/or operational control of the Department of Defense in national security emergencies.” The secretary of defense is also instructed to work with industry, government, and the private sector, to ensure “reliable capabilities for the rapid increase of defense production.”
bullet The Department of Commerce is ordered to develop “control systems for priorities, allocation, production, and distribution of materials and other resources that will be available to support both national defense and essential civilian programs.” The secretary of commerce is instructed to cooperate with the secretary of defense to “perform industry analyses to assess capabilities of the commercial industrial base to support the national defense, and develop policy alternatives to improve the international competitiveness of specific domestic industries and their abilities to meet defense program needs.” The Commerce Department is also instructed to develop plans to “regulate and control exports and imports in national security emergencies.”
bullet The Department of Agriculture is ordered to create plans to “provide for the continuation of agricultural production, food processing, storage, and distribution through the wholesale level in national security emergencies, and to provide for the domestic distribution of seed, feed, fertilizer, and farm equipment to agricultural producers.” The secretary of agriculture is also instructed to “assist the secretary of defense in formulating and carrying out plans for stockpiling strategic and critical agricultural materials.”
bullet The Department of Labor is ordered to develop plans to “ensure effective use of civilian workforce resources during national security emergencies.” The Labor Department is to support “planning by the secretary of defense and the private sector for the provision of human resources to critical defense industries.” The Selective Service System is ordered to develop plans to “provide by induction, as authorized by law, personnel that would be required by the armed forces during national security emergencies.” The agency is also vaguely instructed to establish plans for “implementing an alternative service program.”
bullet The Transportation Department is to create emergency plans to manage and control “civil transportation resources and systems, including privately owned automobiles, urban mass transit, intermodal transportation systems, the National Railroad Passenger Corporation, and the St. Lawrence Seaway Development Corporation.” The Transportation Department is also to establish plans for a “smooth transition” of the Coast Guard to the Navy during a national security emergency. The Transportation Department is additionally instructed to establish plans for “emergency management and control of the National Airspace System, including provision of war risk insurance and for transfer of the Federal Aviation Administration, in the event of war, to the Department of Defense.”
bullet The Department of the Treasury is ordered to develop plans to “maintain stable economic conditions and a market economy during national security emergencies.” The Treasury Department is to provide for the “preservation of, and facilitate emergency operations of, public and private financial institution systems, and provide for their restoration during or after national security emergencies.”

The storm causes billions of dollars in damage, displaces tens of thousands, and leaves hundreds of thousands jobless and without power. After the storm passes, FEMA is slow to take action. The first FEMA relief office opens a full week after the storm hits. Once the agency moves in, red tape, minimal resources, and poor management bog down the relief efforts. Senator Ernest Hollings (D-SC) bluntly describes FEMA’s hierarchy as a “bunch of bureaucratic jackasses” that should just “get the hell out of the way.” Charleston Mayor Joseph P. Riley Jr. criticizes FEMA for not bringing enough people or resources to his city. Retired 20-year Army intelligence veteran, classified security expert, and whistleblower Fred Westerman is hundreds of thousands of dollars in debt and unable to find work in the field he knows best. Beginning in 1985, Westerman headed a security firm that worked on the highly classified Continuity of Government program, which is designed to keep the government functioning in times of disaster (see 1985). The program is predominantly run by the clandestine National Program Office (see (1982 -1991)) and the Federal Emergency Management Agency (FEMA—see April 1, 1979-Present). Westerman reported several instances of waste, fraud, and abuse within the classified program to the FBI, the Army, and the inspector general’s office within FEMA (see 1986-1987). Westerman’s contract with the government was subsequently canceled (see December 1987) and the Justice Department launched an investigation of Westerman and his company when he attempted to file a lawsuit against the government (see November 1988 and November 1988). For the past three years, Westerman has been living in what CNN describes as an “intelligence twilight zone… unable to clear his name, unable to resolve his legal cases… caught in an unwinnable struggle with the powerful secret National Program Office.” Westerman has lost his security clearances, government contracts, and reputation (see 1990). “What assets I did have, have either been sold off or have been mortgaged to the hilt,” he tells CNN. “I am in financial disrepair. I am unemployable in the profession that I know best.” David Mann, a security consultant who served with Westerman, tells CNN: “I think what is happening to him particularly is that the federal attorneys and whoever is driving them to do their job are attempting to ruin the man through legal means.… It is a type of modern McCarthyism if you will.” [CNN Special Assignment, 11/17/1991]

[Source: Greenpeace]Approximately three years after facing harsh criticism for its response to Hurricane Hugo (see September-November 1989), the Federal Emergency Management Agency (FEMA) is denounced for not providing adequate relief in the wake of Hurricane Andrew. The storm, which devastates regions of southern Florida and Louisiana, claims dozens of lives, leaves up to a quarter million people temporarily homeless, and causes more than $26 billion in damage. [National Hurricane Center, 12/10/1993; National Hurricane Center, 8/1/2005] Nearly a week after Andrew passes, local officials and citizens in the hardest hit areas are still waiting for assistance from the federal government. Days after the storm, the New York Times reports it is still “unclear just who is in charge of the Federal relief effort.” [New York Times, 8/27/1982] “Blame for the government’s delayed response to Hurricane Andrew is being placed squarely at the feet of the Federal Emergency Management Agency,” the Associated Press reports. Even after FEMA moves in, relief is delayed by a lack of resources and bureaucratic red tape. [Associated Press, 8/29/1992] In some cases, the agency brings equipment designed for a nuclear war instead of basic supplies. When the city manager of Homestead, Florida, requests 100 hand-held radios, FEMA is only able to provide high-tech mobile command vehicles (see 1982-April 1994). As Cox News Service will later report: “FEMA sent high-tech vans, capable of sending encrypted, multi-frequency radio messages to military aircraft halfway around the world.… FEMA equipment could call in an air strike but Homestead never got its hand-held radios.” Franklin, Louisiana, which is reportedly “flattened” by the storm, is similarly offered a communications vehicle instead of basic relief. “They offered a mobile communications unit and I told them that was unacceptable,” says Representative Billy Tauzin (D-LA). Senator Barbara Mikulski (D-MD) says the government’s response to the storm is “seen by many of Hurricane Andrew’s victims in Florida as a disaster itself.” Unbeknown to most of the public and government, FEMA is secretly preoccupied with preparations for a nuclear doomsday (see April 1, 1979-Present). The Clinton administration reorganizes the Federal Emergency Management Agency (FEMA), shifting resources away from secret projects and into disaster relief programs. During the previous two administrations, FEMA’s resources were overwhelmingly geared towards the highly classified Continuity of Government program, meant to keep the government functioning in times of extreme national emergency (see April 1, 1979-Present). The changes to the disaster agency are prompted by strong criticism of FEMA’s response to Hurricane Andrew (see August-September 1992). The secret COG programs are scaled back, but not totally discontinued. The newly appointed director of FEMA, James Lee Witt, eliminates FEMA’s secretive National Preparedness Directorate and shifts its responsibilities to other sections of the disaster agency. FEMA’s budget shows a dramatic drop in funding for secret projects, from about $100 million in 1993 to only $7.5 million in 1994. “What [Director Witt has] done is put FEMA in an all-hazards approach and put it aboveboard,” says FEMA spokesperson Morrie Goodman. “There are, of course,” Goodman adds, “certain areas that can’t be discussed or even acknowledged. That’s just the nature of the beast.” Indeed, uncertainties remain regarding the true extent of FEMA’s reformation. As Mother Jones magazine notes, the reduced classified budget “reflects only a fragment of FEMA’s investment in doomsday preparations, given that many former projects have been redesignated as ‘dual-use’ responses for both natural disasters and national security emergencies.” According to Mother Jones, “much of the doomsday bureaucracy remains intact, parts of the fifth floor are still restricted, and there has been no concerted effort to declassify the underground command posts.” Government officials will claim in 1994 that the COG program is coming to a total end (see April 18, 1994), but FEMA will continue to pursue its secret agenda for years to come (see April 1, 1979-Present). The Federal Emergency Management Agency (FEMA), known best as a relief agency for victims of natural disasters, is preoccupied with preparations for a nuclear doomsday, according to Cox News Service. FEMA employees planning for natural disasters are outnumbered more than three-to-one by those working for the agency’s National Preparedness Directorate, which is responsible for overseeing preparations for nuclear war. Since its creation, FEMA has been secretly dedicated to the highly classified Continuity of Government (COG) program, meant to keep the government functioning in times of national emergency (see April 1, 1979-Present and 1982-1991). Cox News Service finds: “Only 20 members of Congress—those with adequate security clearance—know that rather than concentrating on natural disasters such as last year’s Hurricane Andrew, the Federal Emergency Management Agency has been gearing up for Armageddon. Government officials say the highly classified “doomsday” project, also known as the Continuity of Government (COG) program, is being shut down. The secretive program was first designed during the cold war to keep the government functioning in the event of a nuclear conflict with the Soviet Union. “The nuclear tensions of that era having subsided, the project has less than six months to live,” the New York Times reports, citing Pentagon officials. [New York Times, 4/18/1994] Despite the claims, the classified plans will not be discontinued. The Clinton administration will actually update the protocols and place a new emphasis on weapons of mass destruction and counterterrorism (see June 21, 1995, October 21, 1998 and Early 1998). The COG program will be officially activated for the first time during the 9/11 attacks and later extended indefinitely (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). Concerns that terrorists may obtain a nuclear, chemical, or biological weapon inspire the Clinton administration to assign new counterterrorism responsibilities within the federal government. After at least a year of interagency planning, President Clinton signs classified Presidential Decision Directive 39, US Policy on Counterterrorism. According to author Steve Coll, the directive is the “first official recognition by any American president” of the threat posed by terrorists using weapons of mass destruction. [Coll, 2004, pp. 318] “The acquisition of weapons of mass destruction by a terrorist group, through theft or manufacture, is unacceptable,” the directive declares. “There is no higher priority than preventing the acquisition of this capability or removing this capability from terrorist groups potentially opposed to the US.” PDD-39 is never fully disclosed to the public, but parts of it will be declassified in February 1997. The directive assigns specific counterterrorism responsibilities to the attorney general, the directors of the CIA and FBI, and the secretaries of state, defense, transportation, treasury, and energy. PDD-39 also assigns “Consequence Management” responsibilities to the Federal Emergency Management Agency (FEMA). When PDD-39 is partially declassified, a paragraph reaffirming a controversial detention policy is inadvertently disclosed. The paragraph, which is marked ”(S)” for secret, claims terrorism suspects may be detained by the US anywhere in world without the consent of the home country. “If we do not receive adequate cooperation from a state that harbors a terrorist whose extradition we are seeking, we shall take appropriate measures to induce cooperation,” the directive states. “Return of suspects by force may be effected without the cooperation of the host government, consistent with the procedures outlined in NSD-77, which shall remain in effect.” National Security Directive 77, or NSD-77, was signed by President George H. W. Bush and is entirely classified. Richard Clarke, the chair of the White House’s Counterterrorism Security Group, updates the US Continuity of Government (COG) program. National Security Adviser Sandy Berger has become aware that terrorism and domestic preparedness are now major issues. He suggests the idea of a “national coordinator” for counterterrorism, and that this post should be codified by a new Presidential Decision Directive (PDD). Clarke therefore drafts three new directives. The third, tentatively titled “PDD-Z,” updates the COG program. [Clarke, 2004, pp. 166-167] This program, which dates back to the cold war, was originally designed to ensure the US government would continue to function in the event of a nuclear war with the Soviet Union. [Atlantic Monthly, 3/2004] Clarke will later say it “had been allowed to fall apart when the threat of a Soviet nuclear attack had gone away.” [Clarke, 2004, pp. 167] He will explain: “We thought that individual buildings in Washington, and indeed perhaps all of Washington, could still come under attack, only it might not be from the former Soviet Union.… It might be with a terrorist walking a weapon into our city.” [CBS, 9/11/2001] Therefore, “If terrorists could attack Washington, particularly with weapons of mass destruction, we needed to have a robust system of command and control, with plans to devolve authority and capabilities to officials outside Washington.” [Clarke, 2004, pp. 167] President Clinton will sign “PDD-Z” on October 21, 1998, as PDD-67, “Enduring Constitutional Government and Continuity of Government Operations” (see October 21, 1998). The two other directives drafted by Clarke will become PDD-62 (see May 22, 1998) and PDD-63. [Clarke, 2004, pp. 170; Washington Post, 6/4/2006] By February 1999, according to the New York Times, Clarke will have written at least four classified presidential directives on terrorism, which “expand the government’s counterterrorism cadres into the $11 billion-a-year enterprise he now coordinates.” [New York Times, 2/1/1999] Clarke is a regular participant in secret COG exercises (see (1984-2004)), and will activate the COG plan for the first time on the day of 9/11 (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001).

The bipartisan panel was put together in 1998 by then-President Bill Clinton and then-House Speaker Newt Gingrich. Hart and Rudman personally brief National Security Adviser Condoleezza Rice, Defense Secretary Donald Rumsfeld, and Secretary of State Colin Powell on their findings. The report has 50 recommendations on how to combat terrorism in the US, but all of them are ignored by the Bush administration.
Shelved by White House - According to Hart, Congress will begin to take the commission’s suggestions seriously in March and April, and legislation is introduced to implement some of the recommendations. Then, “Frankly, the White House shut it down.… The president said, ‘Please wait, we’re going to turn this over to the vice president‘… and so Congress moved on to other things, like tax cuts and the issue of the day.” The White House will announce in May that it will have Vice President Dick Cheney study the potential problem of domestic terrorism, despite the fact that this commission had just studied the issue for 2 1/2 years. Interestingly, both this commission and the Bush administration were already assuming a new cabinet level National Homeland Security Agency would be enacted eventually, even as the public remained unaware of the term and the concept. Cannot Get Meeting with Bush - At the meeting with Rice, Rudman says he wants to see President Bush, and is planning to deliver a “blunt and very direct” warning to him that he needs to deal early in his presidency with the question of domestic terror threats. Rice initially agrees to pass on Rudman’s request for a meeting with Bush, but nothing happens. Rudman will contact Rice’s office several times, but still no meeting is arranged. Rudman will later say he is “disappointed” by this, adding, “There’s no question in my mind that somebody at the White House dropped the ball on this.” [Shenon, 2008, pp. 56-57]
Ignored by 9/11 Commission - Hart will be incredulous that neither he nor any of the other members of this commission are ever asked to testify before the 9/11 Commission. [Salon, 4/6/2004] The 9/11 Commission will later make many of the same recommendations as this commission. However, it will barely mention the Hart/Rudman Commission in its final report, except to note that Congress appointed it and failed to follow through on implementing its recommendations. Bush declares, “Should our efforts to reduce the threat to our country from weapons of mass destruction be less than fully successful, prudence dictates that the United States be fully prepared to deal effectively with the consequences of such a weapon being used here on our soil.” Bush says a new agency within the Federal Emergency Management Agency (FEMA), known as the Office of National Preparedness, will be “responsible for implementing the results of those parts of the national effort overseen by Vice President Cheney that deal with consequence management.” The Office of National Preparedness appears to be a reincarnation of FEMA’s old National Preparedness Directorate (NPD), which was disbanded by the Clinton administration in 1993 (see January 1993-October 1994). During the 1980s and early 1990s, the NPD secretly spent billions of dollars preparing for nuclear war and other national emergencies as part of the highly classified Continuity of Government (COG) program (see February 1993, 1982-1991, and April 1, 1979-Present). [Cox News Service, 2/22/1993] Under the Bush administration, the Office of National Preparedness (ONP) will apparently take over where the National Preparedness Directorate left off. According to Bush, the ONP “will coordinate all Federal programs dealing with weapons of mass destruction consequence management within the Departments of Defense, Health and Human Services, Justice, and Energy, the Environmental Protection Agency, and other federal agencies.” Cheney, who played a central role in the COG program during the Reagan administration (see 1981-1992 and 1980s), informs CNN, “[O]ne of our biggest threats as a nation” could be “domestic terrorism, but it may also be a terrorist organization overseas or even another state using weapons of mass destruction against the US.… [W]e need to look at this whole area, oftentimes referred to as homeland defense.” According to FEMA, the ONP will be up and running as early as the summer of 2001. President Bush says he “will periodically chair a meeting of the National Security Council to review these efforts.” [CNN, 5/8/2001; White House, 5/8/2001; New York Times, 7/8/2002] Cheney is meant to head a group that will draft a national terrorism response plan by October 1. [Chicago Sun-Times, 5/5/2001; Insight on the News, 6/18/2001] But, according to Barton Gellman of the Washington Post, “Neither Cheney’s review nor Bush’s took place.” [Washington Post, 1/20/2002] Former Senator Gary Hart (D-CO) later implies that Bush assigned this specific role to Cheney in order to prevent Congress from enacting counterterrorism legislation proposed by a bipartisan commission he had co-chaired in January (see January 31, 2001). [Source: Public domain]About a week before 9/11, Federal Emergency Management Agency (FEMA) Director Joe Allbaugh replaces the agency’s acting deputy director, John Magaw, a veteran federal law enforcement agent and experienced counterterrorism official, with Michael Brown, a close friend of his and a long-time political associate with no previous experience in emergency management. [Baker, 2009, pp. 484] Magaw is a former director of the US Secret Service and of the Bureau of Alcohol, Tobacco, and Firearms (ATF). In December 1999, Magaw was appointed at FEMA to coordinate the agency’s domestic terrorism efforts. [Market Wire, 12/1999] Allbaugh nominated Michael Brown as the agency’s general counsel upon taking office in January. Brown previously worked as a lawyer for a horse racing association. He has no experience in disaster management (See March 1, 2003). According to Russ Baker, an independent investigative journalist and author of Family of Secrets, a Bush family expose: “One day, Mr. Allbaugh came in and said, ‘I know you’ve got these other things to do. I’m going to ask Mr. Brown to be deputy,’ recalled Magaw who promptly returned to the subordinate position assigned him by Clinton. The timing was remarkable. [Source: Elise Moore / FEMA]Bruce Baughman, director of the planning and readiness division of the Federal Emergency Management Agency (FEMA), takes charge at FEMA headquarters in Washington, DC, because more senior FEMA officials, including the agency’s director, are away from the capital. FEMA Director Joseph Allbaugh and Lacy Suiter, FEMA’s assistant director of readiness, response, and recovery, are in Big Sky, Montana, attending the annual conference of the National Emergency Management Association (see September 8-11, 2001 and After 8:46 a.m. September 11, 2001). Baughman, who led FEMA’s response to the Oklahoma City bombing in April 1995 (see 8:35 a.m. - 9:02 a.m. April 19, 1995), therefore has to take charge of FEMA’s response to today’s terrorist attacks. In this capacity, he is responsible for activating FEMA’s emergency operations center, dispatching disaster medical personnel to the scenes of the attacks, and establishing emergency communications for New York. After the Twin Towers come down (see 9:59 a.m. September 11, 2001 and 10:28 a.m. September 11, 2001), he calls up the first FEMA urban search and rescue teams, which specialize in rescuing people from collapsed structures. FEMA Will Help Local Agencies Respond to the Attacks - In May, Bush put FEMA in charge of responding to terrorist attacks in the United States (see May 8, 2001). [White House, 5/8/2001; Los Angeles Times, 5/9/2001] The agency therefore plays a key role in the government’s response to today’s attacks. The emergency response team at its headquarters is activated today, along with all 10 of its regional operations centers. It also activates its federal response plan, which, it states, “brings together 28 federal agencies and the American Red Cross to assist local and state governments in response to national emergencies and disasters.” It deploys eight urban search and rescue teams to New York to search for victims in the debris from the collapsed World Trade Center buildings, and four urban search and rescue teams to the Pentagon to assist the response there. These teams consist mainly of local emergency services personnel, and are trained and equipped to handle structural collapses. At some point after the White House is ordered to evacuate and while Air Force One is preparing to take off in Florida, counterterrorism “tsar” Richard Clarke activates the Continuity of Government (COG) plan. The coordinator for Continuity of Government has joined Clarke in the White House Situation Room. Clarke asks, “How do I activate COG?” Recalling this conversation, he will later comment, “In the exercises we had done, the person playing the president had always given that order.” But the coordinator replies, “You tell me to do it.” Soon after, Clarke instructs him, “Go.” [Clarke, 2004, pp. 8]
First Time COG Plan Activated - The Continuity of Government plan, which dates back to the Reagan administration, had originally prepared to set up a new leadership for the US in the event of a nuclear war. This is apparently the first time it has ever been put into effect. Clarke will recall, “Every federal agency was ordered… to activate an alternative command post, an alternative headquarters outside of Washington, DC, and to staff it as soon as possible.” Cabinet officers are dispatched around the country, and people in Congress are taken to alternative locations.
Clarke Regularly Particiated in COG Exercises - Since the 1980s, Clarke has in fact been a regular participant in secret COG exercises that rehearsed this plan (see (1984-2004)). [Washington Post, 4/7/2004; ABC News, 4/25/2004] Vice President Dick Cheney and Secretary of Defense Donald Rumsfeld also participated (see 1981-1992). [Atlantic Monthly, 3/2004] Kenneth Duberstein, formerly President Reagan’s White House chief of staff, who took part in the exercises as well, will recall: “I said to myself, as we proceeded through the day [of 9/11], ‘It’s working.’ All those days of patriotic duty were coming back and they were working.” According to ABC News, “If executive branch leaders and large numbers of congressmen had been killed in an attack on the United States, the plan could have gone further, officials suggest, perhaps even with non-elected leaders of the United States taking control and declaring martial law.” [ABC News, 4/25/2004] According to a White House timeline of the events of 9/11, it is in fact Cheney that “orders implementation of Continuity of Government and Continuity of Operations procedures,” at 9:55 a.m., although, according to the Washington Post, Cheney only “officially implemented the emergency Continuity of Government orders,” rather than activating the plan. [Source: Greg Schaler / FEMA]Joseph Allbaugh, the director of the Federal Emergency Management Agency (FEMA), is flown back to Washington, DC, after leaving a major conference he has been attending in Montana. [State Government News, 10/2001 pdf file; CNN, 10/4/2001; 119th Fighter Wing, 10/25/2001] Allbaugh was one of hundreds of emergency management officials from around the US attending the annual conference of the National Emergency Management Association (NEMA) in Big Sky, Montana, which began on September 8 and was originally scheduled to continue until September 12 (see September 8-11, 2001). He was the keynote speaker at the conference, and in his speech the previous day, September 10, talked about his focus on improving capabilities and preparing for disaster. Allbaugh Sees Second Attack on TV - Allbaugh will later recall that on this morning, he “turned on CNN” and “actually saw the second plane hit the tower.” He will comment, “I thought it was a movie clip,” but then “reality started sinking in.” When he learned that the plane was the second to have hit the World Trade Center, he knew “immediately it was terrorism.” [CNN, 10/4/2001] Allbaugh went into the meeting he was due to attend and announced: “You all will have to excuse me. I have more pressing matters.” [Associated Press, 9/8/2002] He was then one of the first to leave the NEMA conference. [New York Times, 9/12/2001]
Conflicting Accounts of Flight - Allbaugh is subsequently flown back to Washington, although there are conflicting accounts of his journey. Allbaugh will later recall that after leaving the conference, he moved on to the city of Bozeman, Montana, and then “waited a couple of hours for a plane.” Finally, he will say, a KC-135 military tanker plane flies him back to the capital. [CNN, 10/4/2001] According to another account, Major Rick Gibney, a pilot with the 119th Fighter Wing of the North Dakota Air National Guard, was originally tasked with flying Allbaugh home in his F-16 fighter jet, but, instead, an Air Force C-17 cargo plane is diverted to transport the FEMA director back to Washington. [119th Fighter Wing, 10/25/2001] But the Gainesville Sun will report that Allbaugh initially headed out from the conference with Craig Fugate, the director of Florida’s Division of Emergency Management. Fugate rented a car to drive back to Florida and Allbaugh joined him as a passenger. Allbaugh was then dropped off in Missouri, from where he is flown back to Washington. Allbaugh Joins President and Others at the White House - Allbaugh will recall that his flight to Washington takes four and a half hours. After arriving back in the capital, he heads directly to the White House, where he spends the evening with the president, vice president, and many others. [CNN, 10/4/2001] It is unclear when exactly Allbaugh arrives in Washington, though he will be at the White House by 7:15 p.m., when he gives a press briefing. [White House, 9/11/2001]
Allbaugh in Charge of Responding to Domestic Terrorist Attacks - In May this year, President Bush put Allbaugh, as FEMA director, in charge of “consequence management” in response to any terrorist attacks in the United States. Allbaugh was charged with creating an Office of National Preparedness to coordinate the government’s response to any such attack (see May 8, 2001). [White House, 5/8/2001; Los Angeles Times, 5/9/2001] FEMA plays an important part in the government’s response to the attacks in New York and Washington on this day. It puts its “federal response plan” into effect, which involves coordinating with 28 other federal agencies and the American Red Cross; it dispatches eight urban search and rescue teams to New York to search for victims in the rubble of the WTC; and it has four urban search and rescue teams sifting through the remains of the crash at the Pentagon. After FEMA is incorporated into the Department of Homeland Security (see March 1, 2003), veteran FEMA employees complain of a massive “brain drain.” FEMA “has gone downhill within the department, drained of resources and leadership,” I.M. “Mac” Destler, a professor at the University of Maryland School of Public Policy, will tell the Washington Post shortly after the 2005 Hurricane Katrina disaster. At least one veteran FEMA staff member, Pleasant Mann, complains on the record about the changes FEMA is undergoing (see Mid-September 2004). [Washington Post, 9/9/2005] Local officials complain that FEMA’s new focus on terrorism threatens other necessary prevention programs. “With the creation of Homeland Security, [natural disaster prevention programs] have taken a backseat,” says Walter Maestri, emergency management director in Jefferson Parish. “To us, it is pretty obvious which is the greater threat. Consistent with its strategy to outsource disaster management functions (see Summer 2004), FEMA solicits bids for a contract to develop a hurricane disaster management plan for Southeastern Louisiana. FEMA’s “Scope of Work” for the contract demonstrates that it is acutely aware of the region’s vulnerability to hurricanes, and of the inadequacy of current plans to manage a major hurricane effectively. According to the document, FEMA and the Louisiana Office of Emergency Preparedness “believe that the gravity of the situation calls for an extraordinary level of advance planning to improve government readiness to respond effectively to such an event.” FEMA describes the catastrophe that will result when a hurricane strikes Southeastern Louisiana. For example, FEMA writes that “the emergency management community has long feared the occurrence of a catastrophic disaster” that would cause “unprecedented levels of damage, casualties, dislocation, and disruption that would have nationwide consequences and jeopardize national security.” It cites “various hurricane studies” predicting that “a slow-moving Category 3 or almost any Category 4 or 5 hurricane approaching Southeast Louisiana from the south could severely damage the heavily populated southeast portion of the state creating a catastrophe with which the State would not be able to cope without massive help from neighboring states and the Federal Government.” FEMA also expressly recognizes that “existing plans, policies, procedures and resources” are inadequate to effectively manage such a “mega-disaster.” The work specified in the contract, awarded to Innovative Emergency Management (IEM) in early June (see June 3, 2004), is to be performed in three stages. During Stage I, scheduled for completion between May 19 and September 30, 2004, IEM will conduct a simulation exercise featuring a “catastrophic hurricane striking southeastern Louisiana” for local, state, and FEMA emergency officials. (FEMA will pay IEM $518,284 for this stage (see July 19-23, 2004)) IEM completes this stage when it conducts the “Hurricane Pam” exercise in July 2004 (see July 19-23, 2004). During Stage 2, IEM will develop a “full catastrophic hurricane disaster plan.” FEMA allocates $199,969 for this stage, which is to be completed between September 23, 2004 and September 30, 2005 (see September 23, 2004). The status of Stage 2 is currently unclear. The third stage relates to earthquake planning for the New Madrid Seismic Zone (NMSZ) in the Central United States. Announcing the award, IEM Director of Homeland Security Wayne Thomas notes that “the greater New Orleans area is one of the nation’s most vulnerable locations for hurricane landfall. The House Committee on Civil Law and Procedure in Louisiana’s House of Representatives votes against Senate Bill 598, which would have provided immunity from civil liability for private drivers who evacuate carless hurricane evacuees. Voting against the measure are Representatives Shirley Bowler, (R-Harahan), and Austin Badon Jr., (D-New Orleans). The measure, already passed in the Senate with a 33-0 vote, was introduced by Senator Francis Heitmeier (D-Algiers) at the request of the New Orleans emergency preparedness office, as well as a coalition of government officials, the Red Cross, and community groups seeking to implement “Operation Brother’s Keeper,” a program designed to increase evacuation of New Orlean’s poor population (see (Spring 2004)). House members who rejected the bill were reportedly concerned that a drunken driver giving a ride to an evacuee could evade responsibility if there was an accident. Representative Badon also argued that immunity was not necessary since a driver’s insurance policy would provide indemnity in the case of an accident. FEMA sponsors a 5-day exercise rehearsing for a mock storm, named “Pam,” that destroys over half a million buildings in New Orleans and forces the evacuation of a million residents. The drill is conducted by Innovative Emergency Management (IEM). [Associated Press, 7/24/2004; Times-Picayune, 7/24/2004; Knight Ridder, 9/1/2005] It is attended by about 250 emergency officials and involves more than 40 federal, state, and local agencies, as well as volunteer organizations. As part of the scenario, about 200,000 people fail to heed evacuation orders. Pam slams directly into New Orleans bringing 120 mph winds, 20 inches of rain, 14 tornadoes, and a massive storm surge that overtops levees flooding the city with 20 feet of water containing a toxic mix of corpses, chemicals, and human waste. Eighty percent of the city’s buildings are damaged. Survivors crawl to the rooftops to wait for help, but rescue workers are impeded by impassable roads. [Federal Emergency Management Agency, 7/23/2004; Knight Ridder, 9/1/2005; New York Times, 9/1/2005; MSNBC, 9/2/2005; Associated Press, 9/9/2005] The flooding results in a massive number of casualties and leaves large portions of southeast Louisiana uninhabitable for more than a year. [Associated Press, 9/9/2005] At the conclusion of the exercise, Ron Castleman, regional director for the Federal Emergency Management Agency, states: “We made great progress this week in our preparedness efforts. Disaster response teams developed action plans in critical areas such as search and rescue, medical care, sheltering, temporary housing, school restoration and debris management. These plans are essential for quick response to a hurricane but will also help in other emergencies.” [Reuters, 9/2/2005] As a result of the exercise, officials come to realize how difficult it will be to evacuate the city’s population in the event of a real hurricane. They expect that only a third of the population will be able leave before the storm hits, in part due to the fact that up to 100,000 residents live in households without a car. When asked how many people might die in such a storm, FEMA spokesman David Passey hesitates before stating, “We would see casualties not seen in the United States in the last century.” [Times-Picayune, 7/20/2004] In December 2004, a 412-page draft report summarizing the exercise will be completed with detailed predictions of what the government should expect in the event that a major hurricane strikes New Orleans.
Predictions - Flood waters would surge over levees, creating “a catastrophic mass casualty/mass evacuation” and leaving drainage pumps crippled for up to six months. “It will take over one year to re-enter areas most heavily impacted,” the report predicts. More than 600,000 houses and 6,000 businesses would be affected, and more than two-thirds of them would be destroyed. Almost a quarter-million children would have no school. “All 40 medical facilities in the impacted area [would be] isolated and useless.” Casualties would be staggering: 61,290 deaths, 187,862 injured, and 196,395 ill. A half million people would be made homeless by the storm. Storm “refugees” would be housed at college campuses, military barracks, hotels, travel trailers, recreational vehicles, private homes, cottages, churches, Boy Scout camps, and cruise ships. Recommendations - “Federal support must be provided in a timely manner to save lives, prevent human suffering and mitigate severe damage. This may require mobilizing and deploying assets before they are requested via normal (National Response Plan) protocols.” [Associated Press, 9/9/2005]
Top officials briefed - Ivor van Heerden, the Louisiana State University hurricane researcher who ran the exercise, reports that a “White House staffer was briefed on the exercise,” and thus, “there is now a far greater awareness in the federal government about the consequences of storm surges.” [Louisiana State University, 2005] After the Hurricane Katrina Disaster, van Heerden will recall in an interview with MSNBC that the federal government didn’t take the exercise seriously. “Those FEMA officials wouldn’t listen to me. Those Corps of Engineers people giggled in the back of the room when we tried to present information.” When Heerden recommended that tent cities be prepared for displaced residents, “their response… was: ‘Americans don’t live in tents’ and that was about it.” [MSNBC, 9/2/2005]
Follow-up - Another exercise is scheduled the following year, but it’s cancelled when its funding is cut (see 2005).

Pleasant Mann, a 16-year FEMA veteran, says in an interview with the Independent Weekly that changes made to the agency by the Bush administration have so severely harmed FEMA staff morale that people are leaving “in droves.” Part of the problem, he says, has to do with the people Bush selected to run the agency. “The biggest frustration here is that we at FEMA have responded to disasters like Oklahoma City and 9/11, and here are people who haven’t responded to a kitchen fire telling us how to deal with terrorism. You know, there were a lot of people who fell down on the job on 9/11, but it wasn’t us… . Since last year, so many people have left who had developed most of our basic programs. A lot of the institutional knowledge is gone. Everyone who was able to retire has left, and then a lot of people have moved to other agencies.” Mann also complains that FEMA’s “priority is no longer on prevention.” FEMA’s merger into the Department of Homeland Security has made mitigation “the orphaned stepchild,” he says. Funding is cut for a FEMA disaster exercise meant to prepare government agencies for a major hurricane in New Orleans. The exercise, a follow-up to the Hurricane “Pam” exercise that was conducted the prior year (see July 19-23, 2004), was to develop a plan to fix such unresolved problems as evacuating sick and injured people from the Superdome and housing tens of thousands of displaced residents. [Knight Ridder, 9/1/2005] “Money was not available to do the follow-up,” Michael Brown, director of the Federal Emergency Management Agency, will later say in an interview with the Associated Press. [Associated Press, 9/9/2005] After the disastrous Hurricane Katrina, Eric Tolbert, FEMA’s former disaster response chief, will tell Knight Ridder Newspapers: “A lot of good was done, but it just wasn’t finished. Bush’s declaration authorizes FEMA to provide appropriate assistance for required emergency measures, including specifically, “[m]easures undertaken to preserve public health and safety and to eliminate threats to public or private property.” In response to this declaration, FEMA Director Michael Brown appoints William Lokey as the Federal Coordinating Officer for federal recovery operations in the affected area. The last time a president issued a pre-impact declaration was when Hurricane Andrew was bearing down on Florida in 1992. Things could change, but as of right now, New Orleans is definitely the target for this hurricane.” Nagin says that New Orleans will follow the state’s evacuation plan, and thus, he will not officially order evacuations until 30 hours before expected landfall, to allow those residents in low-lying surrounding areas to leave first. The last Amtrak train leaves New Orleans, with equipment—but no passengers. Earlier, Amtrak decided to run a nonscheduled train from New Orleans to Macomb Mississippi to move equipment out of harm’s way. Amtrak representative Cliff Black will later assert that Amtrak offered to take New Orleans evacuees on the train, which has room for several hundred passengers, but the city declined the offer. At 9:30 am this morning, Mayor Nagin announces the first-ever mandatory evacuation of New Orleans. After reading the official declaration, Nagin states: “Ladies and gentlemen, I wish I had better news for you. But we are facing a storm that most of us have feared. I do not want to create panic. But I do want the residents to understand that this is very serious, and it’s of the highest nature. And that’s why we are taking this unprecedented move. The storm is now a Cat 5… with sustained winds of 150 miles an hour, with wind gusts of 190 miles per hour. The storm surge most likely will topple our levy system. So we are preparing to deal with that also. So that’s why we’re ordering a mandatory evacuation.” Acknowledging that many people will be unable to obtain transportation, Nagin announces that the city has established ten pickup areas for residents without transportation. City buses will transport residents from the pickup areas to the city’s shelters. The Superdome will open as a shelter of last resort, although Nagin states that, “I want to emphasize, the first choice of every resident should be to leave the city.” The Superdome is likely to be without power for days—and possibly weeks—after the storm fits, and it will not be a comfortable place. Hotels and their patrons are exempted from the order. Police and firefighters will spread out throughout the city sounding sirens and using bullhorns to tell residents to get out. Police may commandeer any vehicle or building that could be used for evacuation or shelter. Nagin concludes his announcement as follows: “This is an opportunity in New Orleans for us to come together in the way that we’ve never come together before. This is a threat that we’ve never faced before. And if we galvanize and rally around each other, I am sure that we will get through this. Bush first explains that he has spoken with FEMA Director Michael Brown (see Before 9:30am August 28, 2005) and with the governors of Alabama, Florida, Louisiana (see Shortly before 9:30 am August 28, 2005), and Mississippi. He announces that he has already signed disaster declarations for Louisiana and Mississippi. Bush then addresses the residents in the storm’s path: “Hurricane Katrina is now designated a Category 5 hurricane. We cannot stress enough the danger this hurricane poses to Gulf Coast communities. I urge all residents to put their own safety and the safety of their families first by moving to safe ground. Please listen carefully to instructions provided by state and local officials.” Bush then turns to Iraq, congratulating “the people of Iraq on completing the next step in their transition from dictatorship to democracy.” Bush’s brief statement contains 203 words about the pending Katrina disaster, and 819 words about the new Iraqi constitution. Throughout this afternoon and evening, Regional Transit Authority (RTA) and some school buses will run between the designated pick-up areas and the Superdome throughout the afternoon and evening. “They’re using school buses and about everything they can find to get people out of here,” reports French Quarter resident Rob Ramsey. [Commercial Appeal (Memphis), 8/29/2005; Times-Picayune, 8/29/2005 pdf file] Nagin will later explain that the plan is to get people to higher ground: “Get them out of their homes, which—most people are under sea level—Get them to a higher ground and then depending upon our state and federal officials to move them out of harm’s way after the storm has hit.” [MSNBC, 9/11/2005] Neither the number of buses deployed by the city, nor the number of people successfully evacuated on city buses, is known at this time. In the days to come, after publication of a photo showing hundreds of flooded buses, many will question why the city failed to use these buses to evacuate more people. [MSNBC, 9/6/2005] However, as Mayor Nagin will later note, “Sure, there was lots of buses out there. But guess what? You can’t find drivers that would stay behind with a Category 5 hurricane, you know, pending down on New Orleans. We barely got enough drivers to move people on Sunday, or Saturday and Sunday, to move them to the Superdome. We barely had enough drivers for that. So sure, we had the assets, but the drivers just weren’t available.” [MSNBC, 9/11/2005] In fact, officials at all levels of government:
bullet (a) know that that many residents will need transportation (see (1:30 pm) August 27, 2005) (see Between 7:00-8:00 am August 28, 2005) (see Morning August 28, 2005)
bullet (b) know that local officials do not have sufficient resources to evacuate all residents who lack transportation (see (Spring 2004)) (see July 19-23, 2004) ; and
bullet (c) fail to dispatch the number of buses necessary for the evacuation. [Dallas Morning News, 8/29/2005; Advocate (Baton Rouge), 9/9/2005; Boston Globe, 9/11/2005] In short, officials at all levels of government are seeking buses; and officials at all levels of government fail to use the fleet of buses in the city that will be flooded during the hurricane. [MSNBC, 9/6/2005]
Note 1 - MSBNC will later report that it has obtained a draft emergency plan prepared by FEMA, which calls for “400 buses to… evacuate victims.” [MSNBC, 9/6/2005] More details regarding this plan are not yet known.
Note 2 - It is unclear whether Passey’s post-hurricane statement refers to buses requested before the hurricane or after. However, his report that FEMA is scrambling for buses occurs sometime prior to August 29, when it is reported in the Dallas Morning News. Regardless of which bus request (i.e., pre- or post-hurricane) Passey is referencing, it is undisputed that, along with the city and state, FEMA was scrambling for buses pre-hurricane, and that, along with the city and state, FEMA failed to deploy the many city school buses that will be flooded due to the hurricane.
Note 3 - Although not yet clear, it may be that officials elect to stage people at the Superdome because of their inability to deploy sufficient buses, in order to maximize the number of people that can be evacuated from low-lying neighborhoods in the hours leading up to the storm. Had officials used the available buses to transport people out of the city via the clogged interstates, the total number of people evacuated necessarily would have been much smaller. Each bus likely could make only a single run. Instead, the buses can make multiple trips from pickup areas to the Superdome.

FEMA issues a special announcement “warning residents along Gulf Coast states to take immediate action to prepare for dangerous Hurricane Katrina as it approaches land. ‘There’s still time to take action now, but you must be prepared and take shelter and other emergency precautions immediately,’ said Michael D. The 2004 Hurricane Pam exercise (see July 19-23, 2004) indicated that approximately 65 percent of the New Orleans-area population would evacuate before a major hurricane. [Washington Post, 9/11/2005] However, initial reports indicate that the Katrina evacuation has exceeded these expectations—significantly. Almost one million people (or about 80 percent of the population) have left the greater New Orleans area, according to Jeff Smith, Deputy Director of Louisiana’s Emergency Planning. Later, Smith will note that, “Everyone is kind of focusing on response at this point in time. I don’t hear anybody talking about how successful that evacuation was. It probably saved hundreds of thousands of lives, and nobody wants to talk about that.” Smith will acknowledge, however, that up to 100,000 residents may not have evacuated. [National Public Radio, 9/9/2005 Sources: Jeff Smith] When asked about the evacuation of the reported 100,000 residents without transportation, FEMA Director Mike Brown will say “I think enough was done,” adding that his only question is whether the mandatory evacuation should have been announced sooner. [Wall Street Journal, 9/12/2005] Jefferson Parish reports a 70 percent evacuation rate, in part due to a “church buddy program,” which provided rides for approximately 25,000 residents. St. Bernard Parish reports an astounding 90 percent evacuation rate. [Washington Post, 9/11/2005] The Chicago Tribune later reports that the area has achieved 75 percent evacuation. Around midnight, local emergency officials from southeastern Louisiana hold a teleconference with FEMA to discuss plans for responding to Katrina’s aftermath. Local officials are so certain of catastrophe that they ask FEMA to include extra medical staff in its first wave of responders to help the expected casualties. At this point, officials are reportedly following a plan drafted only months ago, as a result of the Hurricane Pam exercise conducted in 2004 (see July 19-23, 2004). [Chicago Tribune, 9/11/2005]
Note - Following the 2004 Hurricane Pam exercise, Innovative Emergency Management (IEM issued a Draft Southeast Louisiana Catastrophic Hurricane Functional Plan (Draft Plan) on August 6, 2004. [Federal Emergency Management Agency, 8/6/2004 pdf file] Whether local officials are following this draft plan, or a later plan, remains unclear at this time. The Chicago Tribune reports that the plan in place provides that local officials should be prepared to deal with the aftermath of the storm for 48 to 60 hours (or until August 31). However, the Draft Plan expressly contemplates that local search and rescue resources will be unavailable to rescue the estimated 500,000 people in flooded or damaged areas. [Federal Emergency Management Agency, 8/6/2004, pp. 69-70, 72 pdf file] Thus, the Louisiana Department of Wildlife and Fisheries, and the US Coast Guard are expected to serve as the primary first-responders, while local officials are tasked with requesting assistance. [Federal Emergency Management Agency, 8/6/2004, pp. 70-74 pdf file] Further, while local parishes are tasked with identifying required support, the Plan recognizes that they may be unable to do so: “State and Federal SAR operations personnel will respond to Parishes without a request if initial assessment indicates that the Parish is severely damaged and is not capable of requesting assistance.” [Federal Emergency Management Agency, 8/6/2004, pp. 75 pdf file] The Plan also contemplates that 500,000 residents will need transport from the initial search and rescue staging area to shelters, and that because the Louisiana National Guard will be otherwise tasked, it will be unable to meet this transportation need. Hurricane Katrina will make landfall in Louisiana in only 48 hours . At Governor Blanco’s request (see Early Morning August 27, 2005), President Bush has declared a state of emergency in Louisiana (see (Midday) August 27, 2005). Low-lying parishes have issued mandatory or recommended evacuations, and New Orleans has issued something between a voluntary and a recommended evacuation (see Morning, August 27, 2005; Evening August 27, 2005). FEMA apparently has sent 10-20 staff members to Louisiana by this time (see 11:00 am August 27, 2005). FEMA publishes a graphic projecting the path of Hurricane Katrina this hour, based on the National Hurricane Center Advisory 21 (see 4:00 am August 28, 2005). FEMA’s graphic indicates that Katrina will pass through New Orleans approximately 32 hours from now, at 2:00 pm tomorrow. [Agency, 8/28/2005 pdf file]

Around this time, FEMA Director Michael Brown sends a letter to DHS Secretary Michael Chertoff, requesting 1,000 additional DHS employees within 48 hours, and 2,000 within seven days. Based on the letter, Brown seeks volunteers to serve as community relations liaisons. Describing Katrina as “this near catastrophic event,” Brown describes the role of the requested volunteers as follows:
bullet Establish and maintain positive working relationships with disaster affected communities and the residents of those communities.
bullet Collect and disseminate information and make referrals for appropriate assistance.
bullet [Identify] potential issues within the community and report[] to appropriate personnel.
bullet Convey a positive image of disaster operations to government officials, community organizations and the public.
bullet Perform outreach with community leaders on available Federal disaster assistance. [Federal Emergency Management Agency, 8/29/2005 pdf file] Natalie Rule, FEMA representative, will later confirm that Brown is seeking volunteers to “answer phones, do community relations and help set up field hospitals,” and similar “non-emergency tasks.” [CNN, 9/7/2005]
Note - When this memo becomes public, many will criticize Brown, charging, for example, that “Brown waited until about five hours after the storm’s landfall before he proposed sending 1,000 federal workers to deal with the aftermath” [Time, 9/11/2005] , or, as the Boston Globe reports, that “[Brown] did not ask the authority to dispatch FEMA personnel to the region until five hours after the storm had passed.” [Boston Globe, 9/11/2005] However these reports fail to recognize that, at the time Brown requests these volunteers, FEMA has already deployed more than 1,000 staff members workers to the area (see August 28, 2005). FEMA issues a release urging “all fire and emergency services departments not to respond to counties and states affected by Hurricane Katrina without being requested and lawfully dispatched by state and local authorities under mutual aid agreements and the Emergency Management Assistance Compact.” According to FEMA Director Michael Brown, “The response to Hurricane Katrina must be well coordinated between federal, state and local officials to most effectively protect life and property. We appreciate the willingness and generosity of our Nation’s first responders to deploy during disasters. But such efforts must be coordinated so that fire-rescue efforts are the most effective possible.” The US Fire Administration, part of FEMA, asks that fire and emergency services organizations remain in contact with their local and state emergency management agency officials for updates on requirements in the affected areas. According to R. David Paulison, US Fire Administrator, “It is critical that fire and emergency departments across the country remain in their jurisdictions until such time as the affected states request assistance.… State and local mutual aid agreements are in place as is the Emergency Management Assistance Compact and those mechanisms will be used to request and task resources needed in the affected areas.” The National Incident Management System is being used during the response to Hurricane Katrina and that self-dispatching volunteer assistance could significantly complicate the response and recovery effort. Boeing is awarded a contract to upgrade the fleet of four E-4B National Airborne Operations Center planes over the next five years. The E-4B is a modified Boeing 747 crammed with electronics to serve as a flying command post in war or during an emergency. The contract is capped at $2 billion, but it is unclear why so much money is needed to modernize such a small number of aircraft. [Defense Industry Daily, 12/27/2005] An E-4B was seen over Washington, DC on 9/11 (see Early September 2001).

Congress, stung into action by the Bush administration’s poor response to Hurricane Katrina and particularly the ineptitude of Michael Brown, the former director of the Federal Emergency Management Agency (FEMA—see Early September 2001), passes a law saying that President Bush must nominate a replacement who has “a demonstrated ability in and knowledge of emergency management,” and “not less than five years of executive leadership.” In a signing statement, Bush says that only he, the head of the executive branch, can decide who to appoint to offices. Therefore, he states, he is ignoring the prohibition. [Savage, 2007, pp. 239-240]
