The North Korean Central News Agency, a government-run media outlet, announces that if the US is ready to conclude a peace treaty with North Korea, then it “will be ready to clear the US of its security concerns.” North Korea is implying that it will cease developing nuclear weapons. But the Bush administration has no interest in establishing peaceful relations with North Korea (see November 2002). [Scoblic, 2008, pp. 239] The US chief arms negotiator for North Korea, Jim Kelly, is asked if the administration might ask the United Nations Security Council to intervene. According to a diplomat present for the exchange, Kelly replies, “The Security Council is for Iraq.” Kelly will later claim not to recall making the statement. [Washington Post, 10/26/2004]

Mohamed ElBaradei, the president of the International Atomic Energy Agency (IAEA), meets with President Bush in the Oval Office to discuss the news of Iran’s restarted nuclear program (see August 2002 and December 12, 2002). ElBaradei tells Bush that the Iranians want to meet with an American delegation to discuss the program, obviously with the intent of negotiating a cessation in return for American concessions. ElBaradei offers to help set up the talks, and even keep them low-profile. But Bush is uninterested. His goal, as he later tells British Prime Minister Tony Blair, is to “free Iran.” Author J. Peter Scoblic will later write that any negotiations that might succeed in shutting down Iran’s nuclear program would also serve to strengthen and legitimize Iran’s government; it is, therefore, worth the risk of a nuclear Iran to continue working towards “regime change” in that nation. This also helps explain why, several months later, Bush officials refused to consider Iran’s offer of the so-called “grand bargain” (see May 4, 2003). [Scoblic, 2008, pp. 247]

North Korean leader Kim Jong Il sends a letter to President Bush saying, “If the United States recognizes our sovreignty and assures non-aggression, it is our view that we should be able to find a way to resolve the nuclear issue in compliance with the demands of a new century.” The Bush administration has already ignored one recent proffer from North Korea (see October 27, 2002); it responds to this one by cutting off the monthly shipments of heavy fuel oil as mandated by the Agreed Framework (see October 21, 1994). Following six attacks by different radical Islamic groups in Tunisia (see April 11, 2002), Pakistan, Yemen (see October 6, 2002), Kuwait, Bali (see October 12, 2002), and Moscow, a new audio message is released by a man said by some to be Osama bin Laden, although the identity of the speaker will be disputed (see November 29, 2002). The voice on the tape outlines a principle he says he and his allies are using: reciprocity. He comments: “If it pains you to see your victims and your allies’ victims in Tunisia, Karachi, Failaka, and Oman, then remember that our children are murdered daily in Palestine and Iraq… If it pains you to see your victims in Moscow, then remember ours in Chechnya. How long will fear, killing, destruction, displacement, orphaning, and widowing be our sole destiny, while security, stability, and happiness is yours? This is injustice. The release of an audio message by a man thought to be Osama bin Laden (see November 12, 2002) sparks several publications to run stories about the authentication of the voice on the tape. These articles make several points about voice analysis of apparent bin Laden recordings:
bullet Machine analysis: Some aspects of voice identification are done my machine. Voice authentication software measures the acoustic qualities of a person’s voice, such as pitch, loudness, basic resonances, frequency, and amplitude. [New Scientist, 11/13/2002; Slate, 11/15/2002] This produces spectrographic information and can also be used to look for specific features of a voice, such as a nasal quality. In addition, every person creates the same sounds using a slightly different set of basic pitches, so the set of frequencies in bin Laden’s vowels, like those in “ea” from “fear,” will be marginally different from anyone else’s. By examining this frequency detail for every vowel and comparing them to previous examples, a machine analysis can tell if they are the same and were all said by him. [Slate, 11/15/2002] However, “People hardly ever pronounce the same word the same way twice, even in the same utterance,” says Robert Berkovitz, a speech analyst with Sensimetrics Corp. bullet Human analysis: Some aspects of voice identification are done by humans, who are, according to Slate, “very good at doing the kind of thing most people do subconsciously—telling if someone comes from a particular region by recognizing basic vowel and consonant qualities.” For example, a human analyst can tell whether the “Ye” sound in “Yemen” is of the right length and stress for bin Laden’s dialect. [Slate, 11/15/2002] Experts listen to previous recordings of bin Laden, and compare them syllable by syllable. [New Scientist, 11/13/2002; Slate, 11/15/2002] Experts can also verify whether words on a tape generally match those uttered by someone of bin Laden’s age and educational background. bullet Quality of tape: According to Slate, the November tape is “allegedly very noisy and possibly went down a phone line at some point.” [Slate, 11/15/2002] However, the New Scientist reports, “Voice analysis experts say the quality of the recording appears good enough to determine if the recording is genuine.” It also quotes Steve Cain of Forensic Tape Analysis, a company that received snippets of the tape from US media, who says, “It seems like it is at least clear enough and there’s enough amplitude of that unknown speaker’s voice that if you had a known sample of bin Laden it would be possible.” [New Scientist, 11/13/2002]

The authenticity of a new audio tape purportedly made by bin Laden, in which he praises recent attacks in Bali, Kuwait, Yemen and Moscow (see November 12, 2002), is disputed by Swiss voice analysts. US officials believe the voice is “almost certainly” bin Laden, but the Dalle Molle Institute for Perceptual Artificial Intelligence in Switzerland, one of the world’s leading voice-recognition institutes, is 95 percent certain the tape is a forgery. [BBC, 11/13/2002; BBC, 11/18/2002; BBC, 11/29/2002; Toronto Star, 12/16/2002] Two weeks after it was broadcast, a British newspaper publishes the complete text of a “letter to the American people,” purportedly written by bin Laden. Two months after the September 2002 Defense Intelligence Agency report (see September 2002)—which found there was no conclusive evidence Iraq has chemical weapons—another secret document titled, “Iraq’s Nuclear, Biological and Chemical Weapon and Missile Program: Progress, Prospects, and Potential Vulnerabilities,” is completed. It also says in very clear terms that there is no solid proof that Iraq has chemical weapons. One passage from the report says, “No reliable information indicates whether Iraq is producing and stockpiling chemical weapons or where the country has or will establish its chemical agent production facility.” [US Department of Defense, n.d.; US News and World Report, 6/13/2003]

In a speech to the Air National Guard Senior Leadership Conference in Denver, Vice President Dick Cheney calls Saddam Hussein’s government an “outlaw regime” and accuses the leader of “harboring terrorists and the instruments of terror,” asserting that his government “has had high-level contacts with al-Qaeda going back a decade and has provided training to al-Qaeda terrorists.” [White House, 12/2/2002; Washington Post, 12/3/2002] This latter comment appears to be based on a September 2002 briefing to Cheney’s staff by the Defense Department’s Office of Special Plans, which is aggressively pushing allegations of al-Qaeda-Iraq links (see September 16, 2002). FBI agents raid Ptech offices.FBI agents raid Ptech offices. [Source: ABC News]Federal agents search the offices of Ptech, Inc., a Boston computer software company, looking for evidence of links to Osama bin Laden. A senior Ptech official confirms that Yassin al-Qadi, one of 12 Saudi businessmen on a secret CIA list suspected of funneling millions of dollars to al-Qaeda, was an investor in the company, beginning in 1994. Ptech appears to have connections to other potential terrorist financiers (see 1994). In particular, there seem to be many ties between Ptech and BMI Inc., a New Jersey-based company whose list of investors has been called a “who’s who of designated terrorists and Islamic extremists” (see 1986-October 1999). [Newsweek, 12/6/2002; WBZ 4 (Boston), 12/9/2002] A former FBI counterterrorism official states, “For someone like [al-Qadi] to be involved in a capacity, in an organization, a company that has access to classified information, that has access to government open or classified computer systems, would be of grave concern.” [WBZ 4 (Boston), 12/9/2002] On the day after the raid, US authorities will claim that Ptech’s software has been scrutinized and poses no danger. But security expert John Pike comments, “When you look at all of the different military security agencies that they have as customers, it’s very difficult to imagine how they would not be encountering sensitive information, classified information.” [National Public Radio, 12/8/2002] The search into Ptech is part of Operation Greenquest, which has served 114 search warrants in the past 14 months involving suspected terrorist financing. Fifty arrests have been made and $27.4 million seized. [Forbes, 12/6/2002] However, the raid appears to have been largely for show. Ptech was notified by US officials in November that they were being investigated, and they were told in advance exactly when the raid would take place (see May-December 5, 2002). Top officials in the US government appear to have made up their minds before the results of the raid can even be examined. White House Press Secretary Ari Fleischer comments on the Ptech raid only hours after it ends: “The one thing I can share with you is that the products that were supplied by this company to the government all fell in the nonclassified area. None of it involved any classified products used by the government. The material has been reviewed by the appropriate government agencies, and they have detected absolutely nothing in their reports to the White House that would lead to any concern about any of the products purchased from this company.” [White House, 12/6/2002] The fact that the raid takes place at all appears to be due to the persistence of Operation Greenquest investigators, who are engaged at this time in a bureaucratic battle with other investigators over who will control US government investigations into terrorist financing (see After March 20, 2002-Early 2003). Greenquest will lose this battle early in 2003 and get shut down (see May 13-June 30, 2003). In his 2003 book Black Ice, author Dan Verton will call Ptech an “innocent” casualty of Operation Greenquest’s “scorched-earth” tactics. [Verton, 2003, pp. 223] No charges will be brought against Ptech, and the company will continue fulfilling sensitive government contracts under a new name (see May 14, 2004).

The Institute for Science and International Security (ISIS) releases a report saying that satellite photos indicate that Iran is constructing two nuclear facilities (see August 2002). The report says the first facility, near Arak, is a heavy-water production facility, which raises concerns that Iran might be constructing a nuclear reactor moderated by heavy water. Lending further suspicion to the purpose behind the heavy-water facility is the fact that the Russian-built Bushehr nuclear reactor does not use heavy water. Additionally, ISIS reports, Iran’s existing research reactors do not consume enough heavy water to warrant the need for a heavy-water plant. The report also says that Iran appears to be building a uranium enrichment plant, possibly using gas centrifuge technology, at a site called Natanz, 25 miles southeast of the city of Kashan. [Institute for Science and International Security, 12/12/2002; Nuclear Threat Initiative, 12/13/2002] The following day, Iran’s UN Ambassador Javad Zarif tells CNN that his country is not developing nuclear weapons. “No. Absolutely not,” Zarif says in response to a question on whether Iran is developing a nuclear weapons program. “Iran is a member of the [Nuclear] Nonproliferation Treaty. We have safeguard agreements with the IAEA. Nuclear weapons and other weapons of mass destruction do not have a place in our defense doctrine. We have stated that clearly. The International Atomic Energy Agency (IAEA) submits a preliminary report to the UN Security Council on the results of the inspections so far. The report says: “To date, no new information of significance has emerged regarding Iraq’s past nuclear program (pre-1991) or with regard to Iraq activities during the period between 1991 and 1998…. [N]o evidence of ongoing prohibited nuclear or nuclear-related activities has been detected, although not all of the laboratory results of sample analysis are yet available.” [Reuters, 1/9/2003; International Atomic Energy Agency, 1/9/2003; New York Times, 1/10/2003; Independent, 1/10/2003; Guardian, 1/10/2003] It also states that Washington’s claim that the aluminum tubes were meant for a centrifuge is highly unlikely. In one section of the report, its authors write: “While the matter is still under investigation and further verification is foreseen, the IAEA’s analysis to date indicates that the specifications of the aluminum tubes sought by Iraq in 2001 and 2002 appear to be consistent with reverse engineering of rockets. While it would be possible to modify such tubes for the manufacture of centrifuges, they are not directly suitable for it.” [Reuters, 1/9/2003; International Atomic Energy Agency, 1/9/2003; New York Times, 1/10/2003; Independent, 1/10/2003; Guardian, 1/10/2003] The IAEA preliminary conclusion on the tubes stems from a visit by inspectors to a metal fabrication factory in Nasser where they had found 13,000 completed rockets, all produced from 7075-T6 aluminum tubes. Iraqi engineers working at the facility explained that they had been seeking more aluminum tubes at the time US authorities intercepted the July 2001 shipment (see July 2001) because their supply was low. The engineers provided additional information which supported the view that the tubes were not meant for use in a gas centrifuge. They told the inspectors that the rigid specifications for the tubes were intended to improve the rocket’s accuracy without requiring any major changes to the design. Documents reviewed by the inspectors confirmed the Iraqi engineers’ account. It was also explained that the tubes, which were stored outside, were anodized so they would not corrode. Inspectors confirmed this also. [New York Times, 10/3/2004]

North Korea announces that it is withdrawing from the Nuclear Nonproliferation Treaty (see December 12, 1985). Since its attempts to reopen diplomatic talks with the US were rejected (see October 27, 2002 and November 2002), it has announced its restarting of its nuclear energy program (see December 12, 2002) and expelled international inspectors (see December 31, 2002). Around this same time, it begins removing some 8,000 spent fuel rods from storage, a direct indication that it intends to restart its nuclear weapons program. This is a burgeoning crisis for the world, as North Korea is, in many experts’ view, the definition of a “rogue nation,” but the Bush administration refuses to recognize it as a crisis. In 2008, author J. Peter Scoblic will write, “President Bush, focused on Iraq, refused to label it as such.” North Korea has enough nuclear material to make six to eight nuclear weapons; some experts believe it already has one or two. With the inspectors gone, the world has no way to know what North Korea is doing with its spent fuel rods, or where they are being stored—removing the possibility that the US could destroy them with a targeted air strike. Bush’s response to the North Korean crisis is contradictory. While labeling it a member of the “axis of evil” (see January 29, 2002), and sometimes acting belligerently towards that nation (see March 2003-May 2003), he also insists that the US will not use military force to restrain North Korea’s nuclear ambitions. Diplomacy is the answer to the crisis, Bush says, but his administration refuses to talk to the North Koreans (see November 2002) until later in the month (see Mid-January 2003). [Source: Ali Haider / EPA / Corbis]On January 26, 2003, Newsweek reports that in 2002, Islamist militant leader Abu Musab al-Zarqawi “supposedly went to Baghdad, where doctors amputated his leg (injured in Afghan fighting) and replaced it with a prosthesis.” Newsweek also claims that al-Zarqawi “is supposed to be one of al-Qaeda’s top experts on chemical and biological weapons” and that he also met with “Hezbollah militants” and “Iranian secret agents.” This new account builds on previous reports claiming that al-Zarqawi was in Baghdad for some unspecified medical treatment (see October 2, 2002). The article does note, “Not surprisingly, reports putting al-Zarqawi in Iraq piqued the interest of Pentagon hard-liners eager to find evidence to support their suspicion that Saddam [Hussein] and bin Laden are allied and may have plotted 9/11 together. But neither the CIA nor Britain’s legendary MI6 put much stock in al-Zarqawi’s alleged Iraqi visits, stressing such reports are ‘unconfirmed.’” [Newsweek, 1/26/2003] Despite these caveats, it soon will be widely reported that al-Zarqawi had a leg amputated in Baghdad, with at least the tacit knowledge of the Iraqi government. For instance, several days later, USA Today reports, “To those who operate with and against the shadowy al-Zarqawi, including the Kurds of northern Iraq, he is called ‘the man with the limp.’ That is a reference to a poorly fitting artificial limb that replaced a leg amputated in Baghdad last August.” [USA Today, 2/5/2003] And Secretary of State Colin Powell will claim in his February 5, 2003 presentation to the United Nations that al-Zarqawi went to Baghdad in May 2002 for medical treatment and stayed two months (see February 5, 2003). But in October 2004, Knight Ridder will report, based on a new CIA report (see October 4, 2004), “Al-Zarqawi originally was reported to have had a leg amputated, a claim that officials now acknowledge was incorrect.” [Knight Ridder, 10/4/2004] In early 2006, al-Zarqawi will be seen walking in a videotape, clearly in possession of both his legs. And when he is killed later that year, x-rays of his dead body will show a fracture of his right lower leg, but apparently that was caused by the blast that killed him. [Source: CBS News]US Secretary of State Colin Powell presents the Bush administration’s case against Saddam to the UN Security Council, in advance of an expected vote on a second resolution that the US and Britain hope will provide the justification to use military force against Iraq. [US Department of State, 2/5/2003] At the insistence of Powell, CIA Director George Tenet is seated directly behind him to the right. “It was theater, a device to signal to the world that Powell was relying on the CIA to make his case that Iraq had weapons of mass destruction,” Vanity Fair magazine will later explain. [Bamford, 2004, pp. 371-2; Vanity Fair, 5/2004, pp. 232] In his speech before the Council, Powell makes the case that Iraq is in further material breach of past UN resolutions, specifically the most recent one, UN Resolution 1441 (see November 8, 2002). Sources cited in Powell’s presentation include defectors, informants, communication intercepts, procurement records, photographs, and detainees. [US Department of State, 2/5/2003] Most of the allegations made by Powell are later demonstrated to be false. “The defectors and other sources went unidentified,” the Associated Press will later report. “The audiotapes were uncorroborated, as were the photo interpretations. No other supporting documents were presented. Little was independently verifiable.” [Associated Press, 8/9/2003]
Iraq's December 7 Declaration Was Inaccurate - Powell contends that Iraq’s December 7 declaration was not complete. According to UN Resolution 1441 the document was supposed to be a “currently accurate, full and complete declaration of all aspects” of its programs to develop weapons of mass destruction. But Saddam has not done this, says Powell, who explains that Iraq has yet to provide sufficient evidence that it destroyed its previously declared stock of 8,500 liters of anthrax, as it claimed in the declaration. Furthermore, notes the secretary of state, UNSCOM inspectors had previously estimated that Iraq possessed the raw materials to produce as much as 25,000 liters of the virus. Iraq Has Ties to Al-Qaeda - Powell repeats earlier claims that Saddam Hussein’s government has ties to al-Qaeda. Powell focuses on the cases of the militant Islamic group Ansar-al-Islam and Abu Musab Zarqawi, a Jordanian-born Palestinian, who had received medical treatment in Baghdad during the summer of 2002 (see December 2001-Mid-2002). [US Department of State, 2/5/2003] However, just days before Powell’s speech, US and British intelligence officials—speaking on condition of anonymity—told the press that the administration’s allegations of Iraqi-al-Qaeda ties were based on information provided by Kurdish groups, who, as enemies of Ansar-al-Islam, should not be considered reliable. Furthermore, these sources unequivocally stated that intelligence analysts on both sides of the Atlantic remained unconvinced of the purported links between Iraq and al-Qaeda (see February 3-4, 2003). [Independent, 2/3/2003; Daily Telegraph, 2/4/2003] Powell also claims that Iraq provided “chemical or biological weapons training for two al-Qaeda associates beginning in December 2000.” The claim is based on a September 2002 CIA document which had warned that its sources were of “varying reliability” and that the claim was not substantiated (see September 2002). The report’s main source, Ibn al-Shaykh al-Libi, an al-Qaeda operative who offered the information to CIA interrogators while in custody, later recounts the claim (see February 14, 2004). [CNN, 9/26/2002; New York Times, 7/31/2004; Newsweek, 7/5/2005] Larry Wilkerson, Powell’s chief of staff, will later say that neither he nor Powell ever received “any dissent with respect to those lines… indeed the entire section that now we know came from [al-Libi].” [Newsweek, 11/10/2005] Senior US officials will admit to the New York Times and Washington Post after the presentation that the administration was not claiming that Saddam Hussein is “exercising operational control” of al-Qaeda. Iraq Has Missiles Capable of Flying Up to 1,200 Kilometers - Describing a photo of the al-Rafah weapons site, Powell says: “As part of this effort, another little piece of evidence, Iraq has built an engine test stand that is larger than anything it has ever had. Notice the dramatic difference in size between the test stand on the left, the old one, and the new one on the right. Note the large exhaust vent. This is where the flame from the engine comes out. The exhaust vent on the right test stand is five times longer than the one on the left. The one of the left is used for short-range missiles. The one on the right is clearly intended for long-range missiles that can fly 1,200 kilometers. This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” [US Department of State, 2/5/2003; New York Times, 2/5/2003] But according to the Associated Press, “… UN missile experts have reported inspecting al-Rafah at least five times since inspections resumed Nov. 27, have studied the specifications of the new test stand, regularly monitor tests at the installation, and thus far have reported no concerns.” [Associated Press, 2/7/2003] Similarly, Reuters quotes Ali Jassem, an Iraqi official, who explains that the large stand referred to in Powell’s speech is not yet in operation and that its larger size is due to the fact that it will be testing engines horizontally. [Reuters, 2/7/2003; Guardian, 2/15/2003] Several days later, Blix will report to the UN that “so far, the test stand has not been associated with a proscribed activity.” [Guardian, 2/15/2003]
Iraqis Attempted to Hide Evidence from Inspectors - Powell shows the UN Security Council satellite shots depicting what he claims are chemical weapons bunkers and convoys of Iraqi cargo trucks preparing to transport ballistic missile components from a weapons site just two days before the arrival of inspectors. “We saw this kind of housecleaning at close to 30 sites,” Powell explains. “We must ask ourselves: Why would Iraq suddenly move equipment of this nature before inspections if they were anxious to demonstrate what they had or did not have?” [US Department of State, 2/5/2003] But the photos are interpreted differently by others. An unnamed UN official and German UN Inspector Peter Franck both say the trucks in the photos are actually fire engines. [Mercury News (San Jose), 3/18/2003; Agence France-Presse, 6/6/2003]
'Literally Removed the Crust of the Earth' - Another series of photos—taken during the spring and summer of 2002—show that Iraqis have removed a layer of topsoil from the al-Musayyib chemical complex. This piece of evidence, combined with information provided by an unnamed source, leads Powell to draw the following conclusion: “The Iraqis literally removed the crust of the earth from large portions of this site in order to conceal chemical weapons evidence that would be there from years of chemical weapons activity.” [US Department of State, 2/5/2003; Washington Post, 2/6/2003] Showing another series of pictures—one taken on November 10 (before inspections) and one taken on December 22—Powell says that a guard station and decontamination truck were removed prior to the arrival of inspectors. Powell does not explain how he knows that the truck in the photograph was a decontamination truck. [US Department of State, 2/5/2003; Washington Post, 2/6/2003; Washington Post, 2/6/2003] AP reporter Charles Hanley says that some of Powell’s claims that Iraq is hiding evidence are “ridiculous.” Powell says of a missile site, “This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” Hanley later says, “What he neglected to mention was that the inspectors were underneath, watching what was going on.” [PBS, 4/25/2007]
Communication Intercepts Demonstrate Iraqi Attempts to Conceal Information from Inspectors - Powell plays recordings of three conversations intercepted by US intelligence—one on November 26, another on January 30, and a third, a “few weeks” before. The conversations suggest that the Iraqis were attempting to hide evidence from inspectors. [New York Times, 2/5/2003; US Department of State, 2/5/2003; London Times, 2/6/2003; Sydney Morning Herald, 2/7/2003] Senior administration officials concede to the Washington Post that it was not known “what military items were discussed in the intercepts.” [Washington Post, 2/13/2003] Some critics argue that the intercepts were presented out of context and open to interpretation. [Sydney Morning Herald, 2/7/2003; Sydney Morning Herald, 2/9/2003] Others note that the conversations were translated from Arabic by US translators and were not analyzed or verified by an independent specialist. [Newsday, 2/6/2003]
Biological Weapons Factories - Colin Powell says that US intelligence has “firsthand descriptions” that Iraq has 18 mobile biological weapons factories mounted on trucks and railroad cars. Information about the mobile weapons labs are based on the testimonies of four sources—a defected Iraqi chemical engineer who claims to have supervised one of these facilities, an Iraqi civil engineer (see December 20, 2001), a source in “a position to know,” and a defected Iraqi major (see February 11, 2002). Powell says that the mobile units are capable of producing enough dry biological agent in a single month to kill several thousand people. He shows computer-generated diagrams and pictures based on the sources’ descriptions of the facilities. Powell says that according to the chemical engineer, during the late 1990s, Iraq’s biological weapons scientists would often begin the production of pathogens on Thursday nights and complete the process on Fridays in order to evade UNSCOM inspectors whom Iraq believed would not conduct inspections on the Muslim holy day. [New York Times, 2/5/2003; US Department of State, 2/5/2003; Washington Post, 2/6/2003; Reuters, 2/11/2003] Powell tells the delegates, “The source was an eyewitness, an Iraqi chemical engineer, who supervised one of these facilities. He actually was present during biological agent production runs. He was also at the site when an accident occurred in 1998. Twelve technicians died from exposure to biological agents.” He displays models of the mobile trucks drawn from the source’s statements. [CBS News, 11/4/2007] Responding to the allegation, Iraqi officials will concede that they do in fact have mobile labs, but insist that they are not used for the development of weapons. According to the Iraqis, the mobile labs are used for food analysis for disease outbreaks, mobile field hospitals, a military field bakery, food and medicine refrigeration trucks, a mobile military morgue and mobile ice making trucks. [Guardian, 2/5/2003; ABC News, 5/21/2003] Iraq’s explanation is consistent with earlier assessments of the UN weapons inspectors. Before Powell’s presentation, Hans Blix had dismissed suggestions that the Iraqis were using mobile biological weapons labs, reporting that inspections of two alleged mobile labs had turned up nothing. “Two food-testing trucks have been inspected and nothing has been found,” Blix said. And Ewen Buchanan, spokesman for the UN Monitoring, Verification and Inspection Commission, said, “The outline and characteristics of these trucks that we inspected were all consistent with the declared purposes.” [Guardian, 2/5/2003; ABC News, 5/21/2003]
'Curveball' Primary Source of Claims - Powell’s case is further damaged when it is later learned that one of the sources Powell cited, the Iraqi major, had been earlier judged unreliable by intelligence agents at the Defense Intelligence Agency (see February 11, 2002). In May 2002, the analysts had issued a “fabricator notice” on the informant, noting that he had been “coached by [the] Iraqi National Congress” (INC) (see May 2002). But the main source for the claim had been an Iraqi defector known as “Curveball,” who was initially believed to be the brother of a top aide to Ahmed Chalabi. The source claimed to be a chemical engineer who had helped design and build the mobile labs. His information was passed to Washington through Germany’s intelligence service, the Bundesnachrichtendienst (BND), which had been introduced to the source by the INC. In passing along the information, the BND noted that there were “various problems with the source.” And only one member of the US intelligence community had actually met with the person—an unnamed Pentagon analyst who determined the man was an alcoholic and of dubious reliability. Yet both the DIA and the CIA validated the information. [Veteran Intelligence Professionals for Sanity, 8/22/2003; Los Angeles Times, 3/28/2004; Knight Ridder, 4/4/2004; Newsweek, 4/19/2004; Newsweek, 7/19/2004] Powell says that the US has three other intelligence sources besides Curveball for the mobile bioweapons labs. Powell will be infuriated to learn that none of those three sources ever corroborated Curveball’s story, and sometimes their information contradicted each other. One of the three had failed a polygraph test and was determined to have lied to his debriefers. Another had already been declared a fabricator by US intelligence community, and had been proven to have mined his information off the Internet. [Buzzflash (.com), 11/27/2007] In November 2007, Curveball is identified as Rafid Ahmed Alwan. Serious questions about Curveball’s veracity had already been raised by the time of Powell’s UN presentation. He will later be completely discredited (see November 4, 2007).
Further Problems with Mobile Lab Claims - In addition to the inspectors’ assessments and the dubious nature of the sources Powell cited, there are numerous other problems with the mobile factories claim. Raymond Zilinskas, a microbiologist and former UN weapons inspector, argues that significant amounts of pathogens such as anthrax, could not be produced in the short span of time suggested in Powell’s speech. “You normally would require 36 to 48 hours just to do the fermentation…. The short processing time seems suspicious to me.” He also says: “The only reason you would have mobile labs is to avoid inspectors, because everything about them is difficult. We know it is possible to build them—the United States developed mobile production plants, including one designed for an airplane—but it’s a big hassle. That’s why this strikes me as a bit far-fetched.” [Washington Post, 2/6/2003] After Powell’s speech, Blix will say in his March 7 report to the UN that his inspectors found no evidence of mobile weapons labs (see March 7, 2003). [CNN, 3/7/2003; Agence France-Presse, 3/7/2003; CNN, 3/7/2003] Reporter Bob Drogin, author of Curveball: Spies, Lies and the Con Man Who Caused a War, says in 2007, “[B]y the time Colin Powell goes to the UN to make the case for war, he shows the world artists’ conjectures based on analysts’ interpretations and extrapolations of Arabic-to-German-to-English translations of summary debriefing reports of interviews with a manic-depressive defector whom the Americans had never met. [CIA director George] Tenet told Powell that Curveball’s information was ironclad and unassailable. It was a travesty.” [Alternet, 10/22/2007]
'Four Tons' of VX Toxin - Powell also claims that Iraq has “four tons” of VX nerve toxin. “A single drop of VX on the skin will kill in minutes,” he says. “Four tons.” Hanley later notes, “He didn’t point out that most of that had already been destroyed. And, on point after point he failed to point out that these facilities about which he was raising such alarm were under repeated inspections good, expert people with very good equipment, and who were leaving behind cameras and other monitoring equipment to keep us a continuing eye on it.” [PBS, 4/25/2007]
Iraq is Developing Unmanned Drones Capable of Delivering Weapons of Mass Destruction - Powell asserts that Iraq has flight-tested an unmanned drone capable of flying up to 310 miles and is working on a liquid-fueled ballistic missile with a range of 745 miles. He plays a video of an Iraqi F-1 Mirage jet dispersing “simulated anthrax.” [US Department of State, 2/5/2003; New York Times, 2/5/2003; Washington Post, 2/6/2003] But the Associated Press will later report that the video was made prior to the 1991 Gulf War. Apparently, three of the four spray tanks shown in the film had been destroyed during the 1991 military intervention. [Associated Press, 8/9/2003]
Imported Aluminum Tubes were Meant for Centrifuge - Powell argues that the aluminum tubes which Iraq had attempted to import in July 2001 (see July 2001) were meant to be used in a nuclear weapons program and not for artillery rockets as experts from the US Energy Department, the INR, and the IAEA have been arguing (see February 3, 2003) (see January 11, 2003) (see August 17, 2001) (see January 27, 2003). To support the administration’s case, he cites unusually precise specifications and high tolerances for heat and stress. “It strikes me as quite odd that these tubes are manufactured to a tolerance that far exceeds US requirements for comparable rockets,” he says. “Maybe Iraqis just manufacture their conventional weapons to a higher standard than we do, but I don’t think so.” Powell also suggests that because the tubes were “anodized,” it was unlikely that they had been designed for conventional use. [US Department of State, 2/5/2003; Washington Post, 2/5/2003; Washington Post, 3/8/2003] Powell does not mention that numerous US nuclear scientists have dismissed this claim (see August 17, 2001) (see September 23, 2002) (see December 2002). [Albright, 10/9/2003] Powell also fails to say that Iraq has rockets identical to the Italian Medusa 81 mm rockets, which are of the same dimensions and made of the same alloy as the 3,000 tubes that were intercepted in July 2001 (see After January 22, 2003). [Washington Post, 8/10/2003] This had been reported just two weeks earlier by the Washington Post. [Washington Post, 1/24/2003] Moreover, just two days before, Powell was explicitly warned by the US State Department’s Bureau of Intelligence and Research not to cite the aluminum tubes as evidence that Iraq is pursuing nuclear weapons (see February 3, 2003). [Financial Times, 7/29/2003]
Iraq Attempted to Acquire Magnets for Use in a Gas Centrifuge Program - Powell says: “We… have intelligence from multiple sources that Iraq is attempting to acquire magnets and high-speed balancing machines. Both items can be used in a gas centrifuge program to enrich uranium. In 1999 and 2000, Iraqi officials negotiated with firms in Romania, India, Russia and Slovenia for the purchase of a magnet production plant. Iraq wanted the plant to produce magnets weighing 20 to 30 grams. That’s the same weight as the magnets used in Iraq’s gas centrifuge program before the Gulf War.” [US Department of State, 2/5/2003; New York Times, 2/6/2003] Investigation by the UN’s International Atomic Energy Agency [IAEA] will demonstrate that the magnets have a dual use. IAEA Director Mohamed ElBaradei said a little more than a week before, on January 27, in his report to the Security Council: “Iraq presented detailed information on a project to construct a facility to produce magnets for the Iraqi missile program, as well as for industrial applications, and that Iraq had prepared a solicitation of offers, but that the project had been delayed due to ‘financial credit arrangements.’ Preliminary investigations indicate that the specifications contained in the offer solicitation are consistent with those required for the declared intended uses. However, the IAEA will continue to investigate the matter….” (see January 27, 2003) [Annan, 1/27/2003 pdf file] On March 7, ElBaradei will provide an additional update: “The IAEA has verified that previously acquired magnets have been used for missile guidance systems, industrial machinery, electricity meters and field telephones. Through visits to research and production sites, reviews of engineering drawings and analyses of sample magnets, IAEA experts familiar with the use of such magnets in centrifuge enrichment have verified that none of the magnets that Iraq has declared could be used directly for a centrifuge magnetic bearing.” (see March 7, 2003) [CNN, 3/7/2003]
Iraq Attempted to Purchase Machines to Balance Centrifuge Rotors - Powell states: “Intercepted communications from mid-2000 through last summer show that Iraq front companies sought to buy machines that can be used to balance gas centrifuge rotors. One of these companies also had been involved in a failed effort in 2001 to smuggle aluminum tubes into Iraq.” [US Department of State, 2/5/2003; New York Times, 2/6/2003]
Powell Cites Documents Removed from Home of Iraqi Scientist Faleh Hassan - Powell cites the documents that had been found on January 16, 2003 by inspectors with the help of US intelligence at the Baghdad home of Faleh Hassan, a nuclear scientist. Powell asserts that the papers are a “dramatic confirmation” that Saddam Hussein is concealing evidence and not cooperating with the inspections. The 3,000 documents contained information relating to the laser enrichment of uranium (see January 16, 2003). [Daily Telegraph, 1/18/2003; Associated Press, 1/18/2003; BBC, 1/19/2003; US Department of State, 2/5/2003] A little more than a week later, in the inspectors’ February 14 update to the UN Security Council (see February 14, 2003), ElBaradei will say, “While the documents have provided some additional details about Iraq’s laser enrichment development efforts, they refer to activities or sites already known to the IAEA and appear to be the personal files of the scientist in whose home they were found. Nothing contained in the documents alters the conclusions previously drawn by the IAEA concerning the extent of Iraq’s laser enrichment program.” [Guardian, 2/15/2003; BBC, 2/17/2003; Associated Press, 8/9/2003]
Iraq is Hiding Missiles in the Desert - Powell says that according to unidentified sources, the Iraqis have hidden rocket launchers and warheads containing biological weapons in the western desert. He further contends that these caches of weapons are hidden in palm groves and moved to different locations on a weekly basis. [US Department of State, 2/5/2003] It will later be suggested that this claim was “lifted whole from an Iraqi general’s written account of hiding missiles in the 1991 war.” [Associated Press, 8/9/2003]
Iraq Has Scud Missiles - Powell also says that according to unnamed “intelligence sources,” Iraq has a few dozen Scud-type missiles. [Associated Press, 8/9/2003]
Iraq Has Weapons of Mass Destruction - Secretary of State Colin Powell states unequivocally: “We… have satellite photos that indicate that banned materials have recently been moved from a number of Iraqi weapons of mass destruction facilities. There can be no doubt that Saddam Hussein has biological weapons and the capability to rapidly produce more, many more.” Elsewhere in his speech he says: “We know that Saddam Hussein is determined to keep his weapons of mass destruction, is determined to make more.” [US Department of State, 2/5/2003; CNN, 2/5/2003]
Governments, Media Reaction Mixed - Powell’s speech will fail to convince many skeptical governments, nor will it impress many in the European media. But it will have a tremendous impact in the US media (see February 5, 2003 and After).

'Vast Arsenal' of WMDs - “The regime has never accounted for a vast arsenal of deadly biological and chemical weapons. …. The Iraqi regime has actively and secretly attempted to obtain equipment needed to produce chemical, biological, and nuclear weapons. Firsthand witnesses have informed us that Iraq has at least seven mobile factories for the production of biological agents, equipment mounted on trucks and rails to evade discovery. Using these factories, Iraq could produce within just months hundreds of pounds of biological poisons.… Iraq has never accounted for thousands of bombs and shells capable of delivering chemical weapons. The regime is actively pursuing components for prohibited ballistic missiles. All the world has now seen the footage of an Iraqi Mirage aircraft with a fuel tank modified to spray biological agents over wide areas. Iranian political leader Mohammad Khatami reveals that Iran has begun building two nuclear processing plants devoted to enriching uranium. The head of the International Atomic Energy Agency (IAEA), Mohamed ElBaradei, later says that one of the Iranian plants is already near completion and a second plant is well underway. Although Iran claims that the nuclear plants are strictly for peaceful energy creation, the Bush administration believes that the Iranians have used the cover of practices not strictly forbidden by the Nuclear Nonproliferation Treaty (see July 1, 1968) to hide a nuclear weapons program. One Bush official says that if the Iranians run the Bushehr reactor (see December 12, 2002) for five or six years, withdraw from the Nonproliferation Treaty, just as North Korea has done (see January 10, 2003 and After), and reprocess all of their radioactive material, they would have enough weapons-grade uranium and/or plutonium to build as many as a hundred nuclear weapons. Bush officials hope that a combination of pressure from Russia and the US occupation of neighboring Iraq—one senior Bush official says, “I think the presence of 200,000 American troops on their border for X period of time may tend to concentrate their attention”—may keep Iran’s nuclear program under restraint. Secretary of State Colin Powell obtains an advance transcript of a new audio tape thought to be from Osama bin Laden before it is broadcast on Al Jazeera, but misrepresents the contents to a US Senate panel, implying it shows a partnership between al-Qaeda and Iraq. [CNN, 2/12/2003] Following Powell’s initial claim the tape exists, Al Jazeera says that it has no such tape and dismisses Powell’s statement as a rumor. [Associated Press, 2/12/2003] However, later in the day Al Jazeera says that it does have the tape. [Reuters, 2/12/2003] It is unclear how Powell obtains the advance copy, and Counterpunch even jokes, “Maybe the CIA gave Powell the tape before they delivered it to Al Jazeera?” [CounterPunch, 2/13/2003] In his testimony to the Senate Budget Committee Powell says, “[Bin Laden] speaks to the people of Iraq and talks about their struggle and how he is in partnership with Iraq.” [CNN, 2/12/2003] Powell’s spokesperson, Richard Boucher, says that the recording proves “that bin Laden and Saddam Hussein seem to find common ground.” [Reuters, 2/11/2003; New York Times, 2/12/2003; Washington Post, 11/12/2003] However, although bin Laden tells his supporters in Iraq they may fight alongside the Saddam Hussein, if the country is invaded by the US (see November 12, 2002), he does not express any direct support for the current regime in Iraq, which he describes as “pagan.” [CNN, 2/12/2003] A senior editor for Al Jazeera says the tape offers no evidence of ties between al-Qaeda and Saddam Hussein. “When you hear it, it doesn’t prove any relation between bin Laden or al-Qaeda group and the Iraqi regime,” he argues. [ABC News, 2/12/2003] Several news reports also challenge Powell and Boucher’s interpretation. For example, CNN reveals that the voice had criticized Saddam’s regime, declaring that “the socialists and the rulers [had] lost their legitimacy a long time ago, and the socialists are infidels regardless of where they are, whether in Baghdad or in Aden.” [CNN, 2/11/2003; New York Times, 11/12/2003] Similarly, a report published by Reuters notes that the voice “did not express support for Iraqi President Saddam Hussein—it said Muslims should support the Iraqi people rather than the country’s government.” [Reuters, 2/11/2003]

Popular Science magazine carries a rare interview with Tom Owen, a voice analyst who has worked on identifying Osama bin Laden in recordings allegedly released by the al-Qaeda leader. Owen worked for US media on the identification of bin Laden’s voice in a November 2002 recording (see November 12, 2002), assisted by a captain of the Saudi Interior Ministry’s forensics department he had apparently been teaching at the time. Owen, one of only eight forensic voice analysts certified by the American Board of Recorded Evidence, and other US experts identified the voice as bin Laden’s, although a Swiss facility disagreed (see November 29, 2002). The interview describes Owen’s lab and how he works, pivoting off the November recording. Owen criticizes the Swiss analysis, saying that the advanced biometrics software the Swiss used cannot work with the noise on the tape, as it is “designed to work with perfect samples.” Cleaning up the tape would not help, as this would remove the high and low frequencies a biometric system needs to make its identification.
Voice Identification Methodology - To identify voices, Owen uses a spectrograph, which produces spectrograms—“a kind of graphic speech rendering that has changed little since the 1940s”—that are then compared. His favorite tool for analyses is a “piece of vintage equipment—a reel-to-reel Voice Identification 700 spectrograph built in 1973,” which “differs little from the analog machines US Army intelligence officers built to identify and track German radio operators during World War II.” When analyzing a new recording thought to be from bin Laden, Owen compares the spectrograms it produces with spectrograms from a known bin Laden interview, such as one he granted to ABC in 1998 (see May 28, 1998). According to the magazine, there are “only a half-dozen words in common between the November tape and the ABC interview,” although the standards of the American Board of Recorded Evidence demand 20 identical words, preferably spoken in the same order.
Listening for 'Quirky Mannerisms' - However, Owen also listens for “the multitude of quirky mannerisms and pronunciation foibles peculiar to each voice,” because a trained ear can detect “the subtle whistle caused by a missing tooth, a person’s tendency to swallow in the middle of a sentence, even the way someone sets his or her jaw when speaking.” Owen plays the reporter what he calls a short-term memory tape, apparently a crucial tool in aural voice identifications. The spliced tape toggles between 2.5-second segments of bin Laden’s ABC interview and the November tape; Owen uses the tape to listen for peculiarities in a voice, especially when vowels are spoken. According to Owen, who says bin Laden’s voice is what the magazine calls “plenty peculiar,” the tape proves it is the “same guy” on the November tape and in the 1998 interview. However, the reporter comments: “To my untrained ear, it could be Darth Vader behind the static.… This is the sort of gray area that tends to make legal observers worry about the state of forensic science.”
Comments on NSA - According to the magazine, Owen’s technology is similar to that which the NSA probably uses to analyze voices, although Owen thinks the NSA has samples of bin Laden’s voice he does not. However, he does not think it has made biometric breakthroughs in analysis despite its advanced technology, which is “mostly devoted to listening.” [Popular Science, 2/24/2003]

[MSNBC, 3/3/2003] An insider informant allegedly tips off authorities to KSM’s location, and is given the $25 million reward money for his capture (see Shortly Before February 29 or March 1, 2003). However, some journalists immediately cast serious doubts about this arrest. President Bush holds a press conference—only his eighth since taking office—in which he conflates Iraq and Saddam Hussein with the 9/11 attacks and the global war on terror at least 12 times. For instance, he says: “Iraq is a part of the war on terror. It’s a country that trains terrorists; it’s a country that could arm terrorists. Saddam Hussein and his weapons are a direct threat to this country.” Perhaps his most alarming statement is, “September the 11th should say to the American people that we’re now a battlefield.” [White House, 3/6/2003; Salon, 5/4/2006; PBS, 4/25/2007] Bush insists that he has not yet decided to take military action against Iraq (see March 6, 2003). [Salon, 5/4/2006]
Scripted and Orchestrated - Oddly, none of the 94 assembled journalists challenge Bush’s conflations, no one asks about Osama bin Laden, and no one asks follow-up questions to elicit information past the sound bites Bush delivers. There is a reason for that. In 2007, PBS’s Bill Moyers will report that “the White House press corps will ask no hard questions… about those claims,” because the entire press conference is scripted. “Sure enough, the president’s staff has given him a list of reporters to call on,” Moyers will report. Press Secretary Ari Fleischer later admits to giving Bush the list, which omits reporters from such media outlets as Time, Newsweek, USA Today, and the Washington Post. After calling on CNN reporter John King, Bush says, “This is a scripted—” and then breaks into laughter. King, like his colleagues, continues as if nothing untoward is happening. Author and media commentator Eric Boehlert will later say: “[Bush] sort of giggled and laughed. And, the reporters sort of laughed. And, I don’t know if it was out of embarrassment for him or embarrassment for them because they still continued to play along after his question was done. They all shot up their hands and pretended they had a chance of being called on.” Several questions later, Bush pretends to choose from the available reporters, saying: “Let’s see here… Elizabeth… Gregory… April.… Did you have a question or did I call upon you cold?” The reporter asks, “How is your faith guiding you?” Bush responds: “My faith sustains me because I pray daily. I pray for guidance.” Boehlert will later say: “I think it just crystallized what was wrong with the press coverage during the run up to the war. I think they felt like the war was gonna happen and the best thing for them to do was to get out of the way.” [White House, 3/6/2003; Salon, 5/4/2006; PBS, 4/25/2007]
Defending the Press's Complicity - New York Times reporter Elisabeth Bumiller, a participant in the conference, will later defends the press corps’ “timid behavior,” in Boehlert’s characterization, by saying: “I think we were very deferential because… it’s live, it’s very intense, it’s frightening to stand up there. Think about it, you’re standing up on prime-time live TV asking the president of the United States a question when the country’s about to go to war. There was a very serious, somber tone that evening, and no one wanted to get into an argument with the president at this very serious time.” [Salon, 5/4/2006]
Compliant Media Coverage - The broadcast news media, transmitting the live feed of the conference, could not have been more accommodating, author and media critic Frank Rich will later note. “CNN flashed the White House’s chosen messages in repetitive rotation on the bottom of the screen while the event was still going on—‘People of good will are hoping for peace’ and ‘My job is to protect America.’” After the conference, Fox News commentator Greta van Susteren tells her audience, “What I liked tonight was that in prime time [Bush] said to the American people, my job is to protect the American people.” [Rich, 2006, pp. 70]
Follow-Up Coverage Equally Stage-Managed - Boehlert notes that the post-conference coverage is equally one-sided. On MSNBC’s flagship news commentary show, Hardball, host Chris Matthews spends an hour discussing the conference and the upcoming invasion. Matthews invites six guests on. Five are advocates of the war, and one, given a few moments for “balance,” questions some of the assumptions behind the rationale for war. The five pro-war guests include an “independent military analyst,” retired General Montgomery Meigs, who is one of around 75 retired military officers later exposed as participants in a Pentagon propaganda operation designed to promote the war (see April 20, 2008 and Early 2002 and Beyond). Inspections 'Fruitful,' Say French, Russians - Both sides claim that the reports give further support to each of their respective stances on the issue of Iraqi disarmament. French Foreign Minister Dominique de Villepin tells the Council that the reports “testify to the progress” of the inspections. He states that France will not support another resolution because “we cannot accept any ultimatum, any automatic use of force.” Russian Foreign Minister Igor Ivanov says that the reports demonstrate that inspections have been “fruitful.”
Inspections Not Working, US Claims - The Bush administration does not alter its position, despite statements by the two inspectors that Iraq is cooperating with inspections and complying with demands to disarm. Colin Powell, responding to the inspectors’ reports, reiterates the administration’s position that the inspections are not working and that Saddam is not cooperating. “We must not walk away,” Powell says. “We must not find ourselves here this coming November with the pressure removed and with Iraq once again marching down the merry path to weapons of mass destruction, threatening the region, threatening the world.” He claims that Iraq’s behavior is a “a catalog still of noncooperation” and repeats the administration’s allegation that the “Iraq regime continues to possess and conceal some of the most lethal weapons ever devised.” Back at the White House, Ari Fleischer tells reporters, “As the president has said, if the United Nations will not disarm Saddam Hussein, it will be another international organization, a coalition of the willing that will be made up of numerous nations that will disarm Saddam Hussein.” [CNN, 3/6/2003; CNN, 3/7/2003; Independent, 3/7/2003; US Department of State, 3/7/2003 pdf file]
Bush: Missile Destruction 'Meaningless' - Bush himself will call the destruction of Iraqi missiles “meaningless” and nothing more than an Iraqi “campaign of destruction,” shocking UNMOVIC inspectors: “We didn’t know what to make of [his words],” one inspector says afterwards. Former State Department official Patrick Lang will write: “In the final weeks of the countdown to war, the administration’s actions resembled nothing so much as some of the madder scenes from Alice in Wonderland. The fact that the documents the administration had used to ‘prove’ that Iraq was working on nuclear weapons were forged only led to greater insistence that Iraq was a danger. The absence of discovery of WMD by the UN inspectors was only further evidence that the Iraqis were the greatest deceivers in history and that they had succeeded in concealing their location. The destruction of the Al Samoud missiles was just more evidence of a ‘grand deception.’” [Middle East Policy Council, 6/2004]
Uranium Allegations 'Outrageous,' Says Former Ambassador - The Washington Post and Los Angeles Times do give the story front-page coverage, and on CNN, former ambassador Joseph Wilson (see July 6, 2003) calls the uranium allegation “outrageous,” adding that the claim “taints the whole rest of the case that the government is trying to build against Iraq.” The US government is “simply stupid” for not finding out the truth sooner: “a couple of phone calls” could have proven that such a deal between Iraq and Niger could not have happened: “All this stuff is open,” Wilson says. “It’s a restricted market of buyers and sellers.” [Rich, 2006, pp. 71]
IAEA Report 'Widely Ignored' - Author and media critic Frank Rich will later note, “With America’s March 17 deadline for war (see March 17, 2003 and March 17, 2003) dominating the news, ElBaradei’s pronoucements were widely ignored. The news of the forged uranium documents did not make any of the three network evening newscasts and did not appear in the following day’s New York Times. In a televised address to the nation, shortly before the US officially begins its invasion of Iraq, President George W. Bush justifies the need to use military force. He asserts that the US has “pursued patient and honorable efforts to disarm the Iraqi regime without war,” but that Iraq “has uniformly defied Security Council resolutions demanding full disarmament.” He maintains that Iraq “continues to possess and conceal some of the most lethal weapons ever devised” and “has aided, trained, and harbored terrorists, including operatives of al-Qaeda.… Today, no nation can possibly claim that Iraq has disarmed.” Bush then gives Saddam Hussein an ultimatum, warning the Iraqi leader that if he and his sons do not leave Iraq within 48 hours, the US will use military force to topple his government. The choice is his, Bush says. “Should Saddam Hussein choose confrontation, the American people can know that every measure has been taken to avoid war, and every measure will be taken to win it.” He assures Iraqis that the US will liberate them and bring them democracy and warns Iraq’s military not to destroy its country’s oil wells or obey orders to deploy weapons of mass destruction. British Attorney General Lord Goldsmith warns Prime Minister Tony Blair in a memo that any measures taken in Iraq by the occupying powers not related to the issue of security would be unlawful without an additional security council resolution. “My view is that a further security council resolution is needed to authorize imposing reform and restructuring of Iraq and its government,” Lord Goldsmith writes. “The government has concluded that the removal of the current Iraqi regime from power is necessary to secure disarmament, but the longer the occupation of Iraq continues, and the more the tasks undertaken by an interim administration depart from the main objective, the more difficult it will be to justify the lawfulness of the occupation.” He says that attempts to implement “wide-ranging reforms of governmental and administrative structures,” change the status of public officials or judges except in exceptional cases, or “the imposition of major structural economic reforms would not be authorized by international law.” Goldsmith also expressed this opinion orally during a cabinet meeting. The Los Angeles Times reports that, ironically, the man in charge of security for the nation where the US bases its headquarters for the Iraq war is a supporter of al-Qaeda. Sheik Abdullah bin Khalid al-Thani is the Interior Minister of Qatar. US Central Command and thousands of US troops are stationed in that country. In 1996, al-Thani was Religious Minister and he apparently let 9/11 mastermind Khalid Shaikh Mohammed (KSM) live on his farm (see January-May 1996). Mohammed was tipped off that the US was after him. Some US officials believe al-Thani was the one who helped KSM escape, just as he had assisted other al-Qaeda leaders on other occasions. [Los Angeles Times, 3/28/2003] Another royal family member has sheltered al-Qaeda leaders and given over $1 million to al-Qaeda. KSM was even sheltered by Qatari royalty for two weeks after 9/11 (see Late 2001). [New York Times, 2/6/2003] Ahmad Hikmat Shakir, who has ties to the 1993 World Trade Center bombing (see February 26, 1993), the Bojinka plot (see January 6, 1995), and also attended the January 2000 al-Qaeda summit in Malaysia (see January 5-8, 2000), was sheltered by al-Thani’s religious ministry in 2000. [Newsweek, 9/30/2002] Former counterterrorism “tsar” Richard Clarke says al-Thani “had great sympathy for Osama bin Laden, great sympathy for terrorist groups, was using his personal money and ministry money to transfer to al-Qaeda front groups that were allegedly charities.” However, the US has not attempted to apprehend al-Thani or take any other action against him. The Baghdad Museum is evacuated and locked by its curators, who anticipate Baghdad being overrun by American troops within the next few hours. The last three on the grounds are the director, Dr. Jaber Khalil; the director of the State Board of Antiquities, Donny George; and the curator in charge of the museum’s collections, Dr. Nawala al-Mutawalli. They are forced to flee the grounds because Iraqi militiamen have sought cover around the museum, and they fear a firefight. The entire area is under US control by April 9; by April 10, the Army has left the area without posting guards. George pleads for the Army to return to prevent looting, but is ignored. Much of the looting that ravages the museum’s collection takes place on April 12 (see April 13, 2003). Countless age-old treasures are lost when museums are looted (see April 13, 2003). [Associated Press, 4/10/2003; CBC News, 4/11/2003] US officers at Central Command in Qatar tell CBC news it is up to Iraq’s own civil authorities to stop the looting. “At no point do we really see becoming a police force,” says Brigadier General Vincent Brooks. “What we see is taking actions that are necessary to create stability.” [CBC News, 4/12/2003; Washington Post, 8/18/2005] The Coalition Provisional Authority later estimates the cost of the looting at around $12 billion. According to reporter George Packer, the looting canceled out the “projected revenues of Iraq for the first year after the war. Neoconservative Kenneth Adelman, a former director of the US Arms Control and Disarmament Agency who predicted that the defeat and subsequent occupation of Iraq would be a “cakewalk” (see February 13, 2002), writes in a Washington Post op-ed that it is time for the supporters of the war to celebrate. One aspect of that celebration should be to deride the war’s critics: “Administration critics should feel shock over their bellyaching about the wayward war plan. All of us feel awe over the professionalism and power of the US military. Now we know.” Adelman is quick to pick who he feels is a particularly juicy target: “Taking first prize among the many frightful forecasters was the respected former national security adviser, Brent Scowcroft” (see March 8, 2003). Vice President Cheney is so pleased with Adelman’s column that he invites Adelman to a small celebratory dinner party. The only other guests are Cheney’s chief of staff, Lewis “Scooter” Libby, and Deputy Defense Secretary Paul Wolfowitz. When Adelman arrives, he is so overcome with joy that he bursts into tears and hugs Cheney. They reminisce briefly about the 1991 Gulf War until Adelman interrupts: “Hold it! Hold it! Let’s talk about this Gulf War. It’s so wonderful to celebrate.… Paul and Scooter, you give advice inside and the president listens. Dick, your advice is the most important, the Cadillac.” The war is just fabulous, Adelman gushes. “So I just want to make a toast without getting too cheesy. [Source: Art Daily (.com)]In a press briefing, Defense Secretary Donald Rumsfeld dismisses the wave of looting and vandalism throughout much of Iraq (see April 9, 2003 and After April 9, 2003) with the comment, “Stuff happens.” The looting is “part of the price” for freedom and democracy, he says, and blames “pent-up feelings” from years of oppression under the rule of Saddam Hussein. He goes on to note that the looting is not as bad as some television and newspaper reports are trying to make it out to be (see Late April-Early May, 2003 and May 20, 2003). “Freedom’s untidy, and free people are free to make mistakes and commit crimes and do bad things,” he tells reporters. “They’re also free to live their lives and do wonderful things. And that’s what’s going to happen here.” General Richard Myers, chairman of the Joint Chiefs of Staff, who is with Rumsfeld at the press briefing, agrees. “This is a transition period between war and what we hope will be a much more peaceful time,” he says. CNN describes Rumsfeld as “irritated by questions about the looting.” Rumsfeld says that the images of Iraqi citizens ransacking buildings gives “a fundamental misunderstanding” of what is happening in Iraq. “Very often the pictures are pictures of people going into the symbols of the regime, into the palaces, into the boats and into the Ba’ath Party headquarters and into the places that have been part of that repression,” he explains. “And while no one condones looting, on the other hand one can understand the pent-up feelings that may result from decades of repression and people who’ve had members of their family killed by that regime, for them to be taking their feelings out on that regime.” [US Department of Defense, 4/11/2003; CNN, 4/12/2003]
Accuses the Media of Exaggeration - Rumsfeld accuses the media of exaggerating the violence and unrest throughout the country: “I picked up a newspaper today and I couldn’t believe it. I read eight headlines that talked about chaos, violence, unrest. And it just was Henny Penny—‘The sky is falling.’ I’ve never seen anything like it! And here is a country that’s being liberated, here are people who are going from being repressed and held under the thumb of a vicious dictator, and they’re free. It’s just unbelievable how people can take that away from what is happening in that country! Do I think those words are unrepresentative? Yes.” [US Department of Defense, 4/11/2003] “Let me say one other thing,” he adds. “The images you are seeing on television you are seeing over, and over, and over, and it’s the same picture of some person walking out of some building with a vase, and you see it 20 times, and you think: ‘My goodness, were there that many vases? 'Looting, Lawlessness, and Chaos on the Streets of Iraq' - The next day, Toronto Star columnist Antonia Zerbiasias reports: “All day long, all over the dial, the visuals revealed looting, lawlessness, and chaos on the streets of Iraq. Nothing was off-limits, not stores, not homes, not embassies, certainly not Saddam Hussein’s palaces nor government buildings and, most disgustingly, not even hospitals.” She is “astonished” at Rumsfeld’s words, and observes that “the only free anything the Iraqis are going to get in the next little while is going to be whatever they can ‘liberate’ from electronics shops. Maybe Rumsfeld’s marketing people can come up with a slogan for that.” [Toronto Star, 4/12/2003]
Archaelogists Outraged at Rumsfeld's Remarks - Historians and archaeologists around the world are outraged at Rumsfeld’s remarks. Jane Waldbaum, the president of the Archaeological Institute of America, says her agency warned the US government about possible looting as far back as January 2003. She says she is as horrified by Rumsfeld’s cavalier attitude towards the looting as she is with the looting itself. “Donald Rumsfeld in his speech basically shrugged and said: ‘Boys will be boys. What’s a little looting?’” she says. “Freedom is messy, but freedom doesn’t mean you have the freedom to commit crimes. This loss is almost immeasurable.” [Salon, 4/17/2003]
Failure to Protect Hospitals, Museums - Four days after Rumsfeld makes his remarks, progressive columnist John Nichols notes that had a Democratic or liberal government official made such remarks, Republicans and conservatives would be “call[ing] for the head” of that official. Nichols notes what Rumsfeld failed to: that looters stripped hospitals, government buildings, and museums to the bare walls. He also asks why US soldiers did not stop the looting, quoting the deputy director of the Iraqi National Museum, Nabhal Amin, as saying: “The Americans were supposed to protect the museum. If they had just one tank and two soldiers nothing like this would have happened.” Nichols notes the irony in the selection of the Oil Ministry as the only government building afforded US protection. He concludes: “When US and allied troops took charge of the great cities of Europe during World War II, they proudly defended museums and other cultural institutions. They could have done the same in Baghdad. And they would have, had a signal come from the Pentagon. But the boss at the Pentagon, Donald Rumsfeld, who had promised to teach the Iraqi people how to live in freedom, was too busy explaining that rioting and looting are what free people are free to do.” [Nation, 4/15/2003]
Fired for Confronting Rumsfeld over Remark - Kenneth Adelman, a neoconservative member of the Defense Policy Board (DPB) who before the war said that the invasion of Iraq would be a “cakewalk” (see February 13, 2002), later confronts Rumsfeld over the “stuff happens” remark. In return, according to Adelman’s later recollection, Rumsfeld will ask him to resign from the DPB, calling him “negative.” Adelman will retort: “I am negative, Don. You’re absolutely right. I’m not negative about our friendship. But I think your decisions have been abysmal when it really counted. Start out with, you know, when you stood up there and said things—‘Stuff happens.‘… That’s your entry in Bartlett’s [Famous Quotations]. The only thing people will remember about you is ‘Stuff happens.’ I mean, how could you say that? ‘This is what free people do.’ This is not what free people do. This is what barbarians do.… Do you realize what the looting did to us? It legitimized the idea that liberation comes with chaos rather than with freedom and a better life. And it demystified the potency of American forces. Plus, destroying, what, 30 percent of the infrastructure.” Adelman will recall: “I said, ‘You have 140,000 troops there, and they didn’t do jack sh_t.’ I said, ‘There was no order to stop the looting.’ And he says, ‘There was an order.’ I said, ‘Well, did you give the order?’ He says, ‘I didn’t give the order, but someone around here gave the order.’ I said, ‘Who gave the order?’ So he takes out his yellow pad of paper and he writes down—he says, ‘I’m going to tell you. I’ll get back to you and tell you.’ And I said, ‘I’d like to know who gave the order, and write down the second question on your yellow pad there. Tell me why 140,000 US troops in Iraq disobeyed the order. Write that down, too.’ And so that was not a successful conversation.” [Vanity Fair, 2/2009]

Defense Secretary Donald Rumsfeld, pleased with the propaganda effort of his assistant Victoria Clarke and her use of retired military officers as media analysts to boost the administration’s case for war with Iraq (see Early 2002 and Beyond), sends a memo to Clarke suggesting that the Pentagon continue the propaganda effort after the war has run its course. He writes, “Let’s think about having some of the folks who did such a good job as talking heads in after this thing is over.” As the occupation lasts through the summer and the first signs of the insurgency emerge, the Pentagon quickly counters with its military analysts to reassure the American populace that everything is going well in Iraq (see Summer 2003). [Source: Getty Images / Salon]The New York Times reports that in the four days of looting in Baghdad and other Iraqi cities (see April 9, 2003 and After April 9, 2003), the National Museum of Iraq has been almost completely pillaged. Over 170,000 artifacts have been stolen or destroyed from the museum, which once boasted an irreplaceable collection of artifacts from Mesopotamia dating back as far as 7,000 years. The Times reports that archaeologists and specialists once regarded the museum as “perhaps the richest of all such institutions in the Middle East.” Only today have museum curators and government officials been able to start cataloguing the losses, as the waves of looting have begun to ebb, and fires set in dozens of government buildings begun to burn themselves out. While some treasures may have been stored in safes and vaults, the 28 galleries of the museum, and the museum’s main storage vaults, have been “completely ransacked,” the Times reports. What could not be taken was vandalized; 26 huge statues were methodically decapitated. Museum officials are enraged that US troops refused to protect the building (with one exception, a single intervention on April 10 that lasted about half an hour). The museum’s corridors are littered with smashed ceramics and burned-out torches of rags soaked in gasoline. “All gone, all gone,” one curator says. “All gone in two days.” Iraqi archaeologist Raid Abdul Ridhar Muhammed describes a crowd of thousands of looters armed with rifles, pickaxes, knives, clubs, and hunks of metal torn from automobiles. He watched as they stormed in and out of the complex, carrying precious antiquities away in wheelbarrows and handcarts. Deputy curator Mohsen Hassan watched helplessly as men with sledgehammers smashed glass display cases to get at the valuables inside. Some of the looters were from the impoverished districts of Baghdad, Hassan recalls, but many were middle class citizens who seemed to know just what they were looking for. “Did some of them know the value of what they took?” Hassan says. “Absolutely, they did. They knew what the most valued pieces in our collection were.” Muhammed blames the Americans for not securing the museum, as do many other Iraqis. “A country’s identity, its value and civilization resides in its history,” he says. “If a country’s civilization is looted, as ours has been here, its history ends. Please tell this to President Bush. Please remind him that he promised to liberate the Iraqi people, but that this is not a liberation, this is a humiliation.” [New York Times, 4/13/2003; St. Petersburg Times, 2/6/2005] Later investigations prove that many of the antiquities thought looted were actually hidden away by museum curators (see June 13, 2003).

US troops with the 101st Airborne Division use tools to cut through wire seals on nine explosives-storage bunkers at the Al Qaqaa military facility. The seals were put there by the International Atomic Energy Agency (IAEA) before the invasion, to seal bunkers containing hundreds of tons of conventional high explosives that could be used in the detonation of nuclear weapons. The Airborne soldiers search the bunkers for chemical and biological weapons. After finding no such weapons, the soldiers depart, leaving the bunkers unsealed. A Minnesota television station will broadcast a video of the incident in November 2004. The bunkers will be looted by Iraqis almost immediately thereafter (see Late April-Early May, 2003); by October 2004, the IAEA will report that around 380 tons of high explosives are missing from the facility (see October 10, 2004 and October 25, 2004). About a dozen US soldiers witness looters stealing high explosives from the Al Qaqaa ammunition site in northern Babil Province over a span of several days. The Al Qaqaa facility is where hundreds of tons of some of Iraq’s most powerful conventional explosives have been stored since 1991 (see May 2003); at least nine of its bunkers were unsealed by US troops days before (see April 18, 2003). In October 2004 the International Atomic Energy Agency will inform the US that around 380 tons of high explosives from Qaqaa are missing (see October 10, 2004 and October 25, 2004). The US soldiers, Army reservists and National Guardsmen, will say in November 2004 that they are unable to prevent the looting because they are drastically outnumbered. Some of the soldiers call their commanders to request help in securing the site, but receive no reply. The soldiers later describe watching Iraqis heave explosives from unsecured bunkers into Toyota pickup trucks. They try, with little success, to deter the looters; one noncommissioned officer will recall: “We were running from one side of the compound to the other side, trying to kick people out.… On our last day there, there were at least 100 vehicles waiting at the site for us to leave so looters could come in and take munitions.” Another officer will recall: “It was complete chaos. It was looting like [Los Angeles] during the Rodney King riots.” The soldiers who recall the events for the Los Angeles Times ask not to be identified, fearing reprisals from the Pentagon. When US search teams visit the facility on May 8, they find it “had been looted and stripped and vandalized.” No IAEA-monitored materials are found. No US forces were specifically delegated to guard the Al Qaqaa facility, codenamed “Objective Elm” by US strategists. Marine units are later delegated to guard the facility; one senior Marine officer will say in November 2004: “That site was just abandoned by the 101st Airborne, and there was never a physical handoff by the 101st to the Marines. They just left. We knew these sites were being looted, but there was nothing we could do about it.… There was no plan to prevent these weapons from being used against us a year later.” [Los Angeles Times, 11/4/2004]

The Bush administration will later deny that it planned the “Mission Accomplished” banner that was used during Bush’s public relations event aboard the USS Lincoln (see May 1, 2003), and instead blame the banner on the crew of the Lincoln, who supposedly want to celebrate the end of their own uneventful mission. However, aside from the careful, micromanaged stagecraft used in every moment of the presentation, Secretary of Defense Donald Rumsfeld will later tell reporter Bob Woodward that the banner was a Bush administration PR element. According to Rumsfeld, he had the words “mission accomplished” removed from Bush’s speech: “I took ‘mission accomplished’ out,” he will recall. “I was in Baghdad and I was given a draft of that thing and I just died. And I said, it’s too inclusive.… They fixed the speech, but not the sign.” [Unger, 2007, pp. 305] Five years later, the White House will still insist that it had nothing to do with the creation of the banner (see April 30, 2008).

The International Atomic Energy Agency (IAEA) warns US officials that the Al Qaqaa military facility must be kept under close supervision. The facility has long been a storage cache for hundreds of tons of extremely powerful explosives such as HMX and RDX since 1991, when, in the aftermath of the Gulf War, the UN locked down the facility. In 1996, the United Nations used some of the Al Qaqaa explosives to destroy a large Iraqi germ warfare facility. The IAEA repeatedly warned the US about the explosives cache before the March invasion; with the current wave of looting and depredations occurring around the country (see April 9, 2003), terrorists or other unfriendlies could, the agency says, help “themselves to the greatest explosives bonanza in history.” In October 2004, the IAEA will come to believe that looting of the explosives began in April 2003 because of “the theft and looting of the governmental installations due to lack of security.” That same month, the US media will learn that at least 380 tons of explosives from the Al Qaqaa cache have gone missing (see October 10, 2004 and October 25, 2004). Sadegh Kharrazi, Iran’s ambassador to France and the nephew of Foreign Minister Kamal Kharrazi, drafts a bold proposal to negotiate with the US on all the outstanding conflicts between them. [American Prospect, 5/21/2006] Diplomats refer to the proposal as “the grand bargain.” The US sends neoconservative Zalmay Khalilzad, a senior National Security Council official, to talk with Iran’s UN ambassador, Javad Zarif. [Vanity Fair, 3/2007] The proposal was reviewed and approved by Iran’s top leaders Supreme Leader Ayatollah Ali Khamenei, President Mohammad Khatami, and Foreign Minister Kamal Kharrazi. Tim Guldimann, the Swiss ambassador to Iran, is used as an intermediary since the US and Iran do not have formal diplomatic relations. [Washington Post, 2/14/2007]
bullet According to the language of the proposal, it offers “decisive action against any terrorists (above all, al-Qaeda) in Iranian territory” and “full cooperation and exchange of all relevant information.” In return, Iran wants “pursuit of anti-Iranian terrorists, above all [the Mujahedeen-e Khalq (MEK)],” a dissident Iranian group which the US officially lists as a terrorist organization.
bullet Iran also offers to accept much tighter controls by the International Atomic Energy Agency (IAEA) in exchange for “full access to peaceful nuclear technology.” It proposes “full transparency for security [assurance] that there are no Iranian endeavors to develop or possess WMD” and “full cooperation with IAEA based on Iranian adoption of all relevant instruments (93+2 and all further IAEA protocols).” That is a references to IAEA protocols that would guarantee the IAEA access to any declared or undeclared facility on short notice.
bullet The proposal also offers a dramatic change in Iranian policy towards Israel. Iran would accept an Arab league declaration approving a land-for-peace principle and a comprehensive peace with Israel in return for Israel’s withdrawal to 1967 lines, a softening of Iran’s usual policy.
bullet The proposal further offers to stop any Iranian support of Palestinian opposition groups such as Hamas and proposes to convert Hezbollah into “a mere political organization within Lebanon.” It further offers “coordination of Iranian influence for activity supporting political stabilization and the establishment of democratic institutions and a nonreligious government” in Iraq.
bullet In return, Iran wants a democratic government in Iran, which would mean its Shiite allies would come to power since the Shiites make up a majority of the Iraqi population. The proposal wants the US to remove Iran from its “axis of evil” and list of terrorism sponsors. [American Prospect, 5/21/2006]
US Rejects Offer - The US flatly rejects the idea. “We’re not interested in any grand bargain,” says Undersecretary of State for Arms Control and International Security John Bolton. [Vanity Fair, 3/2007] The American Prospect will later comment that “Iran’s historic proposal for a broad diplomatic agreement should have prompted high-level discussions over the details of an American response.” State Department counterterrorism expert Flynt Leverett will later call it a “respectable effort” to start negotiations with the US. But within days, the US rejects the proposal without even holding an interagency meeting to discuss its possible merits. Guldimann, the Swiss intermediary, is reprimanded for having passed the proposal to the US. [American Prospect, 5/21/2006] Larry Wilkerson, Secretary of State Colin Powell’s chief of staff, will later say that it was a significant proposal for beginning “meaningful talks” between the US and Iran but that it “was a non-starter so long as [Dick] Cheney was Vice President and the principal influence on Bush.” [Newsweek, 2/8/2007] He will also say that the State Department supported the offer, “[b]ut as soon as it got to the Vice President’s office, the old mantra of ‘We don’t talk to evil‘… reasserted itself” and Cheney’s office turned the offer down. [BBC, 1/18/2007] Deputy Secretary of State Richard Armitage will later claim that, “We couldn’t determine what was the Iranians’ and what was the Swiss ambassador’s,” and says that he though the Iranians “were trying to put too much on the table.” National Security Adviser Condoleezza Rice will say of the proposal, “Perhaps somebody saw something of the like” but “I just don’t remember ever seeing any such thing.” [Newsweek, 2/8/2007] Colin Powell will later say that President Bush simply didn’t want to negotiate with an Iranian government that he believed should not be in power. “My position… was that we ought to find ways to restart talks with Iran… But there was a reluctance on the part of the president to do that.” He also says, “You can’t negotiate when you tell the other side, ‘Give us what a negotiation would produce before the negotiations start.’” [Newsweek, 2/12/2007] Days later, Iran will propose a more limited exchange of al-Qaeda prisoners for MEK prisoners, but the US will reject that too (see Mid-May 2003). Author Craig Unger will later write, “The grand bargain was dead. Flush with a false sense of victory, Bush, Cheney, and [Defense Secretary Donald] Rumsfeld felt no need to negotiate with the enormous oil-rich country that shared a border with the country America had just invaded.” [Unger, 2007, pp. 308-309]

Some evidence suggests that elements within the Saudi government were complicit with or behind the attacks (see May 12, 2003). The Saudi government had taken very little action against al-Qaeda prior to this. However, it appears to more aggressively combat al-Qaeda afterward. [Los Angeles Times, 7/16/2004] In early 2006, it will be reported that the Saudis aggressively combat al-Qaeda within Saudi Arabia, but do next to nothing to stop al-Qaeda or its financing outside of the country (see January 15, 2006).

The FBI and Customs Department had been waging a bureaucratic war over control of Operation Greenquest, a controversial but largely fruitful Customs terrorist finance investigation (see After March 20, 2002-Early 2003). On May 13, 2003, Attorney General John Ashcroft and Homeland Security Secretary Tom Ridge signed a memorandum of agreement giving the FBI near total control over all terrorist finance investigations. According to the memorandum, if the FBI feels the case is related to terrorist financing and should belong to them, “the investigation and operation of the matter shall be led by the FBI.” The agreement also effectively ends Greenquest. The memo states, “The Secretary [of Homeland Security] agrees that no later than June 30, 2003, Operation Greenquest will no longer exist as a program name.” [National Review, 5/27/2003]

Saif al-Adel.Saif al-Adel. [Source: FBI]Around May 4, 2003, Iran attempted to start negotiations in an attempt to resolve all outstanding issues between Iran and the US. The US completely rejected the offer within days. Iran immediately comes back with a more limited proposal, offering to hand over a group of al-Qaeda leaders being held in Iran in return for the US to hand over leaders of the Mujahedeen of Iran (MEK). The US had already officially listed MEK as a terrorist group. [American Prospect, 5/21/2006] Iran is believed to be holding a number of top al-Qaeda leaders, including military commander Saif al-Adel and Osama bin Laden’s son Saad bin Laden (see Spring 2002). The US had captured about 4,000 members of MEK in Iraq the month before, in bases where they had been staging attacks against Iran. Iran pledges to grant amnesty to most of the MEK prisoners, try only 65 leaders, forgo the death penalty on them, and allow the Red Cross to supervise the transfer. [Washington Post, 7/9/2004] Iran proposes to start with an exchange of information, offering to share the list of names of al-Qaeda operatives they are detaining in return for the US to share the list of names of MEK operatives US forces has captured in Iraq. This exchange of names is discussed at a White House meeting. Hardliners in favor of regime change in Iran argue that MEK is different than al-Qaeda. President Bush is said to respond, “But we say there is no such thing as a good terrorist.” [American Prospect, 5/21/2006] And he initially seems in favor of a prisoner exchange, saying about the MEK, “Why not? They’re terrorists.” [Washington Post, 7/9/2004] But Bush does not immediately approve the exchange of names, although he does approve the disarming of MEK who have surrendered to US troops and he allows the State Department to continue secret negotiations on the issue of exchanging names and prisoners in Switzerland. But on May 12, 2003, a bombing in Riyadh, Saudi Arabia kills a number of US citizens (see May 12, 2003). Defense Secretary Rumsfeld, Vice President Cheney, and other neoconservatives argue that the bombing was planned by al-Qaeda leaders being held in Iran. [American Prospect, 5/21/2006] The Washington Post will report in 2007 that, “US intelligence officials said there are suspicions, but no proof, that one of [the al-Qaeda leaders in Iran] may have been involved from afar in planning” the Riyadh bombing. Some of Bush’s top advisers argue in favor of trading the prisoners, suggesting that directly interrogating the al-Qaeda leaders could result in important new intelligence leads. But Cheney and Rumsfeld argue that any deal would legitimize Iran’s government. Bush ultimately offers to accept information about the al-Qaeda leaders without offering anything in return. Not surprisingly, Iran refuses. [Washington Post, 2/10/2007] A planned meeting between US and Iranian officials on May 21 is canceled and negotiations come to a halt. The American Prospect will later comment, “In a masterstroke, Rumsfeld and Cheney had shut down the only diplomatic avenue available for communicating with Iran and convinced Bush that Iran was on the same side as al-Qaeda.” [American Prospect, 5/21/2006] Flynt Leverett, a State Department official dealing with Middle East policy, will later say, “Why we didn’t cut this deal is beyond me.” [Washington Post, 7/9/2004] One anonymous senior US official will later say, “One reason nothing came of it was because we knew that there were parts of the US government who didn’t want to give them the MEK because they had other plans for them… like overthrowing the Iranian government.” [MSNBC, 6/24/205]

The UN Security Council unanimously passes Resolution 1483, which lifts sanctions on Iraq, legitimizes the occupation by coalition forces, and gives the occupying powers control over Iraq’s natural resources. The resolution also states that coalition authorities must “comply fully with their obligations under international law including in particular the Geneva Conventions of 1949 and the Hague Regulations of 1907.” The Hague Regulations require that occupying powers respect the laws of the country it occupies. Additionally, the resolution creates the Development Fund for Iraq (DFI), which is to be funded with Iraqi oil revenues, frozen Iraqi assets being held outside the US, and $8.1 billion in funds transferred from the UN-administered Oil-for-Food program. The resolution mandates that Iraq’s DFI funds be “in a transparent manner to meet the humanitarian needs of the Iraqi people… and for other purposes benefiting the people of Iraq.” It requires that management of the funds “be audited by independent public accountants approved by the International Advisory and Monitoring Board of the Development Fund for Iraq.” [UN Security Council, 5/22/2003, pp. 4 pdf file; Guardian, 5/23/2003]

A fact-finding mission sponsored by the Pentagon’s Defense Intelligence Agency arrives in Baghdad to determine whether two trailers found in Iraq (see April 19, 2003; May 9, 2003) are meant for the production of biological weapons. The mission, known as the “Jefferson Project,” is led by a team of eight Americans and one Briton, all experts in the field of biological weapons. Each has “at least a decade of experience in one of the essential technical skills needed for bioweapons production,” according to the Washington Post. Within four hours, according to one of the team members, it becomes “clear to everyone that these [are] not biological labs.” News of the team’s assessment causes a controversy in Washington, where a CIA analyst has already authored a white paper (see May 28, 2003) calling the trailers “the strongest evidence to date that Iraq was hiding a biological warfare program.” [Washington Post, 4/12/2006]

US administrator in Iraq Paul Bremer announces that Iraq’s economy will be revived through “free trade.” “A free economy and a free people go hand in hand,” he says, adding that the occupation powers “would like to see market prices brought into the economy… [and the] privatization of key elements.” State subsidies—which up until now have supplied ordinary Iraqis with affordable food, gasoline, and other essentials—will eventually be eliminated. According to Bremer, “history tells us that substantial and broadly held resources, protected by private property, private rights, are the best protection of political freedom. Building such prosperity in Iraq will be a key measure of our success here.” The Washington Post notes that “Iraqis would most likely not be deciding for themselves what kind of economy will replace the state-planned system that functioned under deposed president Saddam Hussein.” The paper also warns that “dismantling Iraq’s state-managed system holds big risks for the occupation authority at a time when most Iraqis are struggling to get by.” [Agence France-Presse, 5/26/2003; Washington Post, 5/27/2003; Sydney Morning Herald, 5/28/2003] Bremer also announces the creation of a trade-credit authority that would extend generous lines of credit to Iraq’s ministries, government-owned factories, and private companies so they can import needed goods and equipment (much of which had disappeared during the initial period of mass looting, see April 9, 2003). The agency will be funded by private banks and the Central Bank of Iraq [Agence France-Presse, 5/26/2003] , which is being overseen by Peter McPherson, a former deputy Treasury secretary and a Bank of America executive. In the upcoming issue of Vanity Fair, Deputy Secretary of Defense Paul Wolfowitz admits that the Bush administration chose the issue of Iraqi WMD as its primary justification for war, not because it was necessarily a legitimate concern, but because it was, in the words of reporter David Usbourne, “politically convenient.” Wolfowitz also acknowledges that another justification played a strong part in the decision to invade: the prospect of the US being able to withdraw all of its forces from Saudi Arabia (see August 7, 1990) once Saddam Hussein’s regime was overthrown. “Just lifting that burden from the Saudis is itself going to the door” towards making progress elsewhere in achieving Middle East peace, says Wolfowitz. The presence of US forces in Saudi Arabia has been one of the main grievances of al-Qaeda and other Islamist groups. The most controversial statement by Wolfowitz is his acknowledgement that, “For bureaucratic reasons we settled on one issue, weapons of mass destruction, because it was the one reason everyone could agree on.” Usbourne writes, “The comments suggest that, even for the US administration, the logic that was presented for going to war may have been an empty shell.” He notes that finding a rationale for attacking Iraq that was “acceptable to everyone” may refer to Secretary of State Colin Powell, the most prominent Cabinet member to vocally, if privately, oppose the invasion. Powell relied on the WMD issue in his February presentation to the UN Security Council (see February 5, 2003), which many consider to be a key element in the administration’s effort to convince the American citizenry that the invasion was necessary and justified. Democrats: WMD Scare 'Hyped' by Administration - Many Congressional Democrats echo the sentiments of Senator Joseph Biden (D-DE), who says of the administration’s push for war: “I do think that we hyped nuclear, we hyped al-Qaeda, we hyped the ability to disperse and use these weapons. I think that tends to be done by all presidents when they are trying to accomplish a goal that they want to get broad national support for.… I think a lot of the hype here is a serious, serious, serious mistake and it hurts our credibility.” [Washington Times, 5/30/2003]
British Official: Clear That Rationale for War Was False - Former British Foreign Secretary Robin Cook, who quit as leader of the House of Commons to protest the war, says he never believed Iraq had the WMD claimed by US and British government officials. “The war was sold on the basis of what was described as a pre-emptive strike, ‘Hit Saddam before he hits us,’” he says. “It is now quite clear that Saddam did not have anything with which to hit us in the first place.” Former Danish Foreign Minister Niels Helveg Petersen says he is shocked by Wolfowitz’s claim. “It leaves the world with one question: What should we believe?” he says. Wolfowitz Claims Misquoting - After the initial reports of the interview and the resulting storm of controversy and recriminations, Wolfowitz and his defenders will claim that Vanity Fair reporter Sam Tanenhaus misquoted his words and took his statements out of context (see June 1-9, 2003).
Press Official: Selection of WMD as Primary Focus a 'Marketing Choice' - In 2008, current deputy press secretary Scott McClellan will write, “So the decision to downplay the democratic vision as a motive for war was basically a marketing choice.” Reflecting on this choice, he will add: “Every president wants to achieve greatness but few do. As I have heard [President] Bush say, only a wartime president is likely to achieve greatness, in part because the epochal upheavals of war provide the opportunity for transformative change of the kind Bush hoped to achieve. In Iraq, Bush saw his opportunity to create a legacy of greatness. Intoxicated by the influence and power of America, Bush believed that a successful transformation of Iraq could be the linchpin for realizing his dream of a free Middle East. But there was a problem here, which has become obvious to me only in retrospect—a disconnect between the president’s most heartfelt objective in going to war and the publicly stated rationale for that war. As the first signs of the insurgency in Iraq begin emerging, and journalists begin reporting on the increasing violence in that supposedly liberated country, the Pentagon quickly counters with propaganda from its proven cadre of “military analysts”—returned military officers who proved during the run-up to war that they could present the Pentagon’s message about the invasion and occupation in an independent, authoritative, and effective manner (see April 20, 2008 and Early 2002 and Beyond). An internal Pentagon memo encourages its public relations officials to “re-energize surrogates and message-force multipliers,” beginning with its military analysts. The PR staff, led by Assistant Secretary of Defense for Public Affairs Victoria Clark, suggests taking a group of analysts on a tour of Iraq timed to coincide with President Bush’s upcoming request for $87 billion in emergency war financing. FBI agent Robert Wright holds a second press conference, accusing the FBI of obstructing the Vulgar Betrayal investigation before 9/11, and then engaging in a cover up after 9/11. He criticizes what he calls the FBI’s “pathetic anti-terrorism efforts.” He says, “the FBI does not want Congress and others to know how the FBI’s international terrorism unit was instrumental in the collapse of the Middle East peace process. The documents detail how the FBI allowed known terrorists, their co-conspirators and financiers to operate and roam freely throughout the United States while simultaneously turning a blind eye to the criminal activities of terrorists and obstructing those of us who are truly trying to identify them and neutralize them.” He also states, “I blame the FBI’s international terrorism unit for being instrumental in the collapse in the Middle East peace process in the 1990s.” [Federal News Service, 6/2/2003; CNN, 6/19/2003] The FBI responds by launching a dubious disciplinary investigation into Wright (see After June 2, 2003-December 2003). Administrator for Iraq Paul Bremer issues Regulation Number 2, which governs how the Coalition Provisional Authority (CPA) will manage the Development Fund for Iraq. The regulation states that the funds will be “managed in a transparent manner for and on behalf of the Iraqi people, consistent with [UN Security Council] Resolution 1483 (see May 22, 2003), and that all disbursements from the Fund are for purposes benefiting the people of Iraq.” It also says that the CPA will “obtain the services of an independent, certified public accounting firm” to audit the fund’s management. Curators and archaologists report over 170,000 antiquties and artifacts either stolen or destroyed, and massive damage done to the building itself (see April 8-12, 2003 and April 13, 2003). On the other hand, General William Wallace has claimed that “as few as 17 items were unaccounted for” (see May 7, 2003). After some research, Bloom claims that virtually everyone involved in the affair is lying to some degree, and, he writes, “the reporters on the scene have been played for patsies.”
Mystery Man - Apparently, Bloom finds, the controversy centers on Donny George, who is officially the director general of research and study for the State Board of Antiquities. George is not the director of the museum; that position is filled by Dr. Jaber Khalil, who “is never quoted in Western news accounts,” Bloom reports. Instead, George became the museum spokesman early in the occupation. He is also a liar, according to Bloom. Reporters say that George gave them the 170,000 figure on or around April 13. George says he never made such a claim. There were 170,000 pieces in the entire collection, he says, but he has no idea how many were stolen or vandalized. The story has become politicized, Bloom writes, somewhat in the US and far more so in Britain, where war critics have seized on the story as evidence of the lack of respect the Pentagon has for the culture of a nation it has seized. The Pentagon calls the museum a military outpost for Saddam Hussein’s Republican Guard, and its pillaging an understandable reaction from the Iraqi people who hated Hussein and his Ba’athist thugs. After the April looting, archaeological expert Dan Cruikshank, who works for the BBC, attempted to piece together a picture of what exactly was and was not taken. He divided the museum into three main areas:
bullet The galleries themselves. Most of the looting and vandalism took place here. But the galleries had been cleared of much of their valuables. Curators had been planning for this months in advance, having gone through looting after the 1991 Gulf War. They feared both citizen thieves and vengeful Kuwaitis traveling with the US troops. They hid the smaller items, leaving behind only antiquities that could not be stolen without mechanical equipment. Somewhere between 17 and 50 major items were either stolen or vandalized; another 15 items sustained major damage.
bullet The museum offices and conservation rooms, where the safes, keys, and equipment are kept. These areas were heavily looted, but mostly of modern equipment such as computers, fax machines, and copiers.
bullet Five secret storerooms known only to the curators. These are reinforced, locked vaults located in various places throughout the museum. Here is where most of the museum’s treasures were hidden away. Experts who visited the museum after the April looting found that three had not been opened, including one room stuffed with tens of thousands of Greek and Roman gold coins. One had been opened with a key, indicating an inside job. The fifth had been broken into and some items stolen.
Squirreled Away - George was one of the first and loudest of lamenters on April 13, blaming US soldiers for their indifference and lamenting the museum that had been, in Bloom’s description, “overrun by a ravenous horde.” However, George kept a few facts to himself. One, he put the most prized possessions of the museum into a secret vault; only George himself knows where that vault is. Two, many museum staff members took items home to protect them. Three, most of the gold items, including 600 historically priceless pieces of jewelry from the Treasure of Nimrod, are safe in a vault underneath the Iraqi Central Bank. They have been there since the days of the Iran-Iraq war. Four, at least one of the secret storerooms was found to have housed not only antiquities, but parts of a machine gun, an unexploded hand grenade, and a rocket-propelled grenade. The room itself has slit windows giving an excellent field of fire for the street below. This discovery gives some truth to the Army’s contention that its soldiers had taken fire from the museum.
Playing Both Sides - Bloom moves into the realm of admitted speculation in trying to divine George’s underlying motivation. He believes George, who held high rank in the Ba’athist regime, wanted to play his cards close to his chest until he could be sure how everything was going to settle out, not offending either the US occupiers or the Ba’athists, who might, as happened in 1991, end up remaining in power. He also believes George wanted to protect valuable artifacts that had disappeared from the museum long before the war. He wonders if George was collaborating with Saddam Hussein, defending the museum against the depredations of the notoriously rapacious Hussein family (who had no compunctions about selling treasures on the international market), or perhaps both.
Planned Burglary - Bloom and Cruikshank both believe that during the April 12 looting, the same people who plundered the museum in years past came back to steal one more time. Five of the most valuable items were snatched, smuggled out of the country apparently through Damascus, Syria, and sold on the black market in Tehran and Paris. Bloom writes: “That’s what stolen-to-order means. They had lined up buyers in Europe long before the war broke out.” Bloom and Cruikshank also cannot figure out how two of the most valuable artifacts—a 4,500-year-old alabaster relief vase and a 4,250-year-old bronze statue—were stolen. “It would have taken, at the least, a block and tackle, a hoist, and a pickup to get them out of the museum.” Did no one see any of this? Bloom asks.
Real Losses - It seems clear that several thousand antiquities and valuables were indeed looted. The latest figure, from UNESCO and the US Customs Service, hovers around 2,000 to 3,000, notwithstanding the claims of General Wallace. Bloom notes, “Even if the losses are limited to 50 priceless items and 3,000 lesser items, that’s still the most significant robbery of antiquities in living memory.” John Russell of the Massachusetts College of Art said in late May: “It’s only by comparison with the most dire initial reports that said everything was gone that it seems not so bad. Yes, not everything is gone, but major things are.” Other sites suffered worse depredations—the archaelogical digs at Larsa, Nineveh, Hatra, Mosul, Babylon, and the Sumerian city of Umma, among others. Bloom writes: “Lost in all the claims and counter-claims about who was responsible, who was lying, and what was done or not done, was the fact that the whole affair was based on a libel against the Iraqi people—that they would destroy their own citadel of history. It would be the equivalent of thousands of Americans rampaging through the Smithsonian Institution like cannibals.” Cruikshank says flatly, “It is simply not true that the people of Baghdad looted their own museum.” [New York Times, 6/1/2003; United Press International, 6/23/2003]

[Source: Publicity photo, via Byrd Business Review]Soliman Biheiri, the former head of BMI Inc., a New Jersey-based investment firm with ties to many suspected terrorism financiers (see 1986-October 1999), had left the US immediately after a raid of the SAAR network in March 2002 (see March 20, 2002). On this day, he returns to the US and is immediately arrested and interviewed by Customs agent David Kane. Biheiri tells Kane that he has longstanding ties to leaders of the Muslim Brotherhood, a radical Muslim group banned in Egypt. Agents are able to search his laptop computer, and discover ties with Hamas leader Mousa Abu Marzouk. He is also connected to two principals of the banned Al Taqwa Bank (see November 7, 2001), Youssef Nada and Ghaleb Himmat, when their addresses are discovered on his computer as well. Agents say there are “other indications” of connections between Al Taqwa and Biheiri’s company BMI, including financial transactions. [Forward, 10/17/2003; Wall Street Journal, 6/21/2004; Associated Press, 10/12/2004] An e-mail is also discovered showing Biheiri was involved in Saudi multimillionaire Yassin al-Qadi’s financial dealings with Yaqub Mirza, the director of the raided SAAR network. The US froze al-Qadi’s assets in late 2001 (see October 12, 2001). [Wall Street Journal, 9/15/2003] Biheiri will be convicted of immigration fraud in October 2003. Sulaiman Abdul Aziz al-Rajhi.Sulaiman Abdul Aziz al-Rajhi. [Source: Nadec]A CIA report strongly suggests that the Al-Rajhi Bank is being used to finance militants. The bank is one of the biggest in Saudi Arabia, with an estimated $26 billion in assets in 2006. The report states, “Islamic extremists have used Al-Rajhi Banking and Investment Corporation since at least the mid-1990s as a conduit for terrorist transactions… Senior al-Rajhi family members have long supported Islamic extremists and probably know that terrorists use their bank. Reporting indicates that senior al-Rajhi family members control the bank’s most important decisions and that [their] principal managers answer directly to Sulaiman [Abdul Aziz al-Rajhi]. The al-Rajhis know they are under scrutiny and have moved to conceal their activities from financial regulatory authorities.” It adds that in 2002, Sulaiman ordered the bank’s board “to explore financial instruments that would allow the bank’s charitable contributions to avoid official Saudi scrutiny.” US intelligence have extensive circumstantial evidence but no direct proof that bank managers knowingly support terrorism. For instance, the report says that in December 1998, Sulaiman and his brother Salah sent $4 million to Germany and Pakistan using “a unique computer code to send funds at regular intervals to unspecified recipients, suggesting they were trying to conceal the transactions and that the money may have been intended for illegitimate ends.” Islamist operatives in many countries have used the bank, including at least some al-Qaeda leaders and 9/11 hijackers (see Before September 11, 2001). In 1997, US investigators recovered the address book of al-Qaeda financier Wadih El-Hage, and discovered Salah al-Rajhi’s phone number in it (see Shortly After August 21, 1997). Salah is Sulaiman’s brother and co-owner of the bank. In 2002, the US will raid the SAAR Network, a collection of linked financial entities in the US suspected of funding militants. SAAR stands for Sulaiman Abdul Aziz al-Rajhi, and the network was founded and funded by him (see March 20, 2002). [Wall Street Journal, 7/26/2007; Wall Street Journal, 7/26/2007] The US government will subsequently consider taking overt action against the bank, but will ultimately decide against it (see Mid-2003). The bank continues to deny any links to Islamic militancy.

Rohan Gunaratna.Rohan Gunaratna. [Source: George Washington University]Counterterrorism expert Rohan Gunaratna claims to know what was discussed at the al-Qaeda summit held in Malaysia in January 2000 (see January 5-8, 2000). Gunaratna has been described as an “ad hoc adviser to US intelligence officials,” and it is believed he has seen top secret transcripts of 9/11 mastermind Khalid Shaikh Mohammed’s (KSM) recent interrogations in CIA prisons. It has not been explained how he saw such transcripts, but the CIA has not disputed the assertion that he saw them. [Bergen Record, 7/10/2003] In public testimony before the 9/11 Commission, Gunaratna says that “Khalid Shaikh Mohammed chaired that meeting [in Malaysia]. The first two hijackers to enter the United States, they were present at that meeting. So the 9/11 operation is an extension of old Plan Bojinka (see January 6, 1995). So the players of old plan Bojinka, they were not all arrested.… If you read the interrogation of [KSM], who is now in US custody, he has very clearly stated how 9/11 was planned, that it originated from [Bojinka].” However, the 9/11 Commissioners do not ask him any follow-up questions about this. [9/11 Commission, 7/9/2003 pdf file] In the 9/11 Commission’s final report, there will be no mention of any suggestions KSM was at the Malaysia summit or any clear accounting as to who all the attendees were. Their report will also downplay any connections between the 1995 Bojinka plot and the 9/11 plot, which they will claim began in 1999. [9/11 Commission, 7/24/2004, pp. 153-154] However, later on the same day as his testimony, Gunaratna will give more details of what he claims to have learned from KSM’s interrogations in an interview with a reporter. He says that at the summit KSM said al-Qaeda operatives would need to learn to fly commercial airliners in the US as part of a “suicide operation.” However, although KSM had already agreed on the targets with bin Laden, the World Trade Center and the Pentagon were not mentioned at the summit. KSM “was careful not to discuss all the specific plans at that meeting.” The reporter who interviewed Gunaratna notes that “some US intelligence officials” have “pooh-poohed the significance of the Malaysian meeting as a link to Sept. 11,” and if KSM was at the meeting, that “further underscores how the CIA missed an opportunity” to stop the 9/11 attacks. [Bergen Record, 7/10/2003] The CIA had Malaysian intelligence photograph and film the attendees of the summit as they were coming and going, but apparently there was no attempt to monitor what was said in the summit meetings (see January 5-8, 2000 and Shortly After). If Gunaratna is correct, it suggests that the CIA and 9/11 Commission may have withheld some details of KSM’s interrogations to the public that are embarrassing to US intelligence agencies. Note also that doubts have been expressed about the reliability of KSM’s testimony, which was at least partly obtained through the use of torture (see June 16, 2004).

An organization called Veteran Intelligence Professionals for Sanity (VIPS) writes an open letter to President Bush entitled “Intelligence Unglued,” where they warn that unless Bush takes immediate action, the US intelligence community “will fall apart—with grave consequences for the nation.” They say that it is clear his National Security Adviser, Condoleezza Rice, and not CIA Director George Tenet, was responsible for the now-infamous “sixteen words” in his January State of the Union address (see Mid-January 2003 and 9:01 pm January 28, 2003). “But the disingenuousness persists,” they write. “Surely Dr. Rice cannot persist in her insistence that she learned only on June 8, 2003, about former ambassador Joseph Wilson’s mission to Niger in February 2002, when he determined that the Iraq-Niger report was a con-job” (see July 6, 2003). “Rice’s denials are reminiscent of her claim in spring 2002 that there was no reporting suggesting that terrorists were planning to hijack planes and slam them into buildings (see May 16, 2002). In September, the joint Congressional committee on 9/11 came up with a dozen such reports” (see December 24, 1994 and January 6, 1995). It is not only Rice’s credibility that has suffered, they write, but Secretary of State Colin Powell’s as well, “as continued non-discoveries of weapons in Iraq heap doubt on his confident assertions to the UN” (see February 5, 2003). Ultimately, they write, it is Bush’s credibility at stake much more than that of his advisers and cabinet members. They lay the blame for the “disingenuousness” from the various members of the administration at the feet of Vice President Dick Cheney: it was Cheney’s office who sent Wilson to Niger (see (February 13, 2002)), it was Cheney who told the Veterans of Foreign Wars that Saddam Hussein was about to produce a nuclear weapon (see August 26, 2002), all with intelligence he and his staff knew to be either unreliable or outright forgeries—a “deep insult to the integrity of the intelligence process,” they write—it was Cheney and his staff who pressured CIA analysts to produce “cherry-picked” intelligence supporting their desire for war, it was Cheney and his staff who “cooked” the prewar National Intelligence Estimate on Iraq (see October 1, 2002). Bad enough that false intelligence was used to help craft Bush’s State of the Union address, they write, but that “pales in significance in comparison with how it was used to deceive Congress into voting on October 11 to authorize you to make war on Iraq” (see October 10, 2002). VIPS recommends three things for Bush to implement:
bullet Bring an immediate end to White House attempts to exculpate Cheney from what they write is his obvious guilt and ask for his resignation: “His role has been so transparent that such attempts will only erode further your own credibility. Equally pernicious, from our perspective, is the likelihood that intelligence analysts will conclude that the way to success is to acquiesce in the cooking of their judgments, since those above them will not be held accountable. We strongly recommend that you ask for Cheney’s immediate resignation.”
bullet Appoint General Brent Scowcroft, the chair of the Foreign Intelligence Advisory Board, to head “an independent investigation into the use/abuse of intelligence on Iraq.”
bullet Bring UN inspectors back into Iraq. “This would go a long way toward refurbishing your credibility. Equally important, it would help sort out the lessons learned for the intelligence community and be an invaluable help to an investigation of the kind we have suggested you direct Gen. A Wall Street Journal op-ed claims that President Bush never claimed the Iraqis posed an “imminent threat” with their putative WMD programs, and that former ambassador Joseph Wilson is unfairly “moving the goalposts” by saying that the threat posed by Iraq’s WMD never passed what they call the “imminent threat test.” As far back as September 2001, after the attacks on New York and Washington, the Bush administration began claiming that Iraq posed a serious threat to the US (see September 11, 2001-March 17, 2003, Shortly After September 11, 2001, September 14, 2001, August 2002, and September 6, 2002). Bush had apparently characterized Iraq as an “imminent threat” even before becoming president (see May 17, 2000). Defense Secretary Donald Rumsfeld has used the term “imminent threat” (see September 18, 2002), as have other members of the administration, such as press secretary Ari Fleischer, communications chief Dan Bartlett, and Defense Policy Board chief Richard Perle. Vice President Dick Cheney had publicly threatened Iraq with military action as far back as December 2001 (see December 11, 2001). Bush had included Iraq as one of the now-infamous “Axis of Evil” in early 2002 (see January 29, 2002). And Bush, Cheney, and top White House officials had characterized Iraq and Saddam Hussein as a threat since March 2002 (see March 24, 2002, August 15, 2002, August 20, 2002, August 26, 2002, Fall and Winter 2002, September 7, 2002, September 8, 2002, September 8, 2002, September 12, 2002, September 13, 2002, September 18, 2002, September 19, 2002, September 24, 2002, September 26, 2002, October 1, 2002, October 1, 2002, October 3, 2002, October 7, 2002, October 7, 2002, January 10, 2003, and March 6, 2003). Wilson will later observe, “While the Journal may have been technically correct that the president had not uttered those exact words, he [and his top officials] walked right up to the phrase.” He will note that Bush’s “staff and administration allies, of course, had been less concerned about splitting hairs as they promoted the invasion.” [Wilson, 2004, pp. 367-368]

The liberal news publication CounterPunch profiles the “Rumsfeld Group,” a government public relations group put together after the 9/11 attacks to manipulate the media’s reporting of the Bush administration’s war on terror (see Late May 2001). One noteworthy aspect of the profile is the success the “Rumsfeld Group” has had in working with the press to spread its message.
Benador Associates - One of the most effective “perception managers” for the Bush administration is Elena Benador, the media placement expert who runs Benador Associates. She oversees the Middle East Forum, an organization CounterPunch reporter Jeffrey St. Clair calls “a fanatically pro-Zionist paper mill,” and has close connections with some of Washington’s most influential hardliners and neoconservatives, including Michael Ledeen, Charles Krauthammer, Alexander Haig, Max Boot, Daniel Pipes, Richard Perle, and Judith Miller. Benador is given the task of getting these pro-war hawks on the air and in the press as often as possible. She does an excellent job in both getting the placements and crafting the message to ensure that they all make the same points. “There are some things, you just have to state them in a different way, in a slightly different way,” Benador explains. “If not, people get scared.”
Washington Post Particularly Compliant - Many press and television news outlets help promulgate the Pentagon’s story, but, St. Clair will note, few are as reliable or as enthusiastic as the Washington Post. He mentions the example of Private Jessica Lynch, whose story was fed for weeks by an over-the-top report from the Post that was fueled entirely by PR flacks from the Pentagon’s Combat Camera operation (see April 1, 2003 and April 3, 2003). In the months leading up to the Iraq invasion, the Post’s op-eds ran 3 to 1 in favor of attacking Iraq. St. Clair notes that in 1988, the Post shrugged off reports of Saddam Hussein gassing Iranians and his own Iraqis as “a quirk of war”; at that point, the US wanted close relations with the Hussein regime, and wanted to play down Hussein’s depredations. The Post echoed the government’s lack of interest.
Firing of Donahue - St. Clair points to MSNBC’s firing of liberal talk show host Phil Donahue on the eve of the Iraq invasion (see February 25, 2003) as another example of the Pentagon’s reach into the mainstream US media. At the behest of the Pentagon’s PR officials, MSNBC fired Donahue and replaced him with a pro-war broadcast called Countdown: Iraq. While MSNBC blamed “poor ratings” on the firing, in reality Donahue’s ratings were MSNBC’s highest. Instead, the network did not like what it called Donahue’s propensity to have “anti-war, anti-Bush” voices on his show. [CounterPunch, 8/13/2003]

An Associated Press (AP) report provides details of what alleged 9/11 mastermind Khalid Shaikh Mohammed (KSM) has apparently told his CIA interrogators. The article, based on “interrogation reports” reviewed by the AP, makes the following claims:
bullet KSM worked on the Bojinka plot in 1994 and 1995 in the Philippines with Ramzi Yousef, Abdul Hakim Murad, and Wali Khan Amin Shah;
bullet After Yousef and Murad were captured (see January 6, 1995 and February 7, 1995), KSM began to devise a new plot that focused on hijackings on US soil;
bullet KSM first pitched the 9/11 plot to Osama bin Laden in 1996. He wanted bin Laden “to give him money and operatives so he could hijack 10 planes in the United States and fly them into targets”;
bullet After bin Laden agreed in principle, the original plan, which called for hijacking five commercial jets on each US coast, was modified several times. Some versions even had the planes being blown up in mid-air, possibly with the aid of shoe bombs. Bin Laden scrapped various parts of the plan, including attacks on both coasts and hijacking or bombing some planes in East Asia as well;
bullet The original four al-Qaeda operatives bin Laden offered KSM for the plot were eventual hijackers Nawaf Alhazmi and Khalid Almihdhar, as well as Khallad bin Attash and Abu Bara al-Yemeni. “All four operatives only knew that they had volunteered for a martyrdom operation involving planes,” one interrogation report apparently states;
bullet The first major change to the plans occurred in 1999 when the two Yemeni operatives could not get US visas (see April 3, 1999). bullet In 1999, the four original operatives picked for the plot traveled to Afghanistan to train at one of bin Laden’s camps, where they received specialized commando training (see Late 1999);
bullet Al-Qaeda’s Malaysia summit (see January 5-8, 2000) was, according to the report, a “key event in the plot,” although it does not say whether KSM was physically present. On the other hand, it confirms the presence of Jemaah Islamiyah leader Hambali;
bullet KSM communicated with Alhazmi and Almihdhar while they were in the US using Internet chat software;
bullet KSM has never heard of Omar al-Bayoumi, an apparent Saudi intelligence agent who provided some assistance to future 9/11 hijackers Khalid Almihdhar and Nawaf Alhazmi when they arrived in California. Neither did he arrange for anyone else in the US to assist Almihdhar and Alhazmi when they arrived in California. Despite this, Almihdhar and Alhazmi soon made contact with a network of people linked to Saudi intelligence services (see January 15-February 2000 and June 23-July 2001);
bullet Bin Laden canceled the East Asian portion of the attacks in the spring of 2000, because, according to a quote from KSM contained in a report, “it would be too difficult to synchronize” attacks in the United States and Asia;
bullet Around that time, KSM reached out to Jemaah Islamiyah, an al-Qaeda affiliate in Southeast Asia. He began “recruiting JI operatives for inclusion in the hijacking plot as part of his second wave of hijacking attacks to occur after Sept. 11,” one summary reportedly says;
bullet Zacarias Moussaoui also went to Malaysia in the run-up to 9/11 (see September-October 2000);
bullet In its final stages, the plan called for as many as 22 terrorists and four planes in a first wave, followed by a second wave of suicide hijackings that were to be aided possibly by al-Qaeda allies in Southeast Asia;
bullet The hijacking teams were originally made up of members from different countries where al-Qaeda had recruited, but in the final stages bin Laden chose instead to use a large group of young Saudi men to populate the hijacking teams;
bullet KSM told interrogators about other terror plots that were in various stages of planning or had been temporarily disrupted when he was captured, including one planned for Singapore (see June 2001 and November 15-Late December 2001);
bullet KSM and al-Qaeda were still actively looking to strike US, Western, and Israeli targets across the world as of this year. [Associated Press, 9/21/2003]
These statements attributed to KSM are similar to later statements attributed to him by the 9/11 Commission Report. [9/11 Commission, 7/24/2004] The Associated Press article cautions that US authorities are still investigating what KSM is telling them, “to eliminate deliberate misinformation.” [Associated Press, 9/21/2003] KSM made some or all these statements under torture, leading some to question their reliability (see Shortly After February 29 or March 1, 2003, After March 7, 2003, June 16, 2004, and August 6, 2007).

Mahmoud Afif Abdeljalil, a Jordanian, was arrested in the Philippines in early 1995 and accused of supporting the Bojinka plot, but then was let go (see January 6, 1995 and April 1, 1995-Early 1996). He is arrested in the Philippines again on this day while attempting to sell some properties owned by Mohammed Jamal Khalifa, bin Laden’s brother-in-law. [Contemporary Southeast Asia, 12/1/2002; Time, 10/27/2003] Philippine officials call him a suspected al-Qaeda operative who had been in close contact with militants from the Abu Sayyaf and other groups. He is called an “envoy” or “point man” for Khalifa, and reputedly took over some of Khalifa’s business front companies after Khalifa left the country in 1994 (see December 1, 1994). His house was used as a safe-house and meeting place for al-Qaeda operatives. Consequently, internal controls over DFI disbursements were not evaluated. Paul Bremer meets with President Bush in Washington for a private meeting. The Coalition Provision Authority’s effort to implement a number of structural changes to Iraq’s economy is failing, and Washington needs to rethink its strategy. Members of the US-backed Iraqi interim government oppose the changes, and corporate attorneys are advising their clients that Bremer’s orders opening up Iraq to foreign investment could be challenged by a future Iraqi government on the basis that the orders violated UN Resolution 1483 (see May 22, 2003). That resolution stated that the US and Britain were bound to the Hague Regulations of 1907, which bars occupying powers from changing the laws of the occupied country (see October 18, 1907). If corporations purchase Iraqi state assets, and a future elected government declares Bremer’s orders illegal, the companies could lose their investments, the lawyers warn. The risk is so great that not a single insurance company is willing to insure its corporate clients for the “political risk” of losing their investment to expropriation. Bremer returns to Iraq from Washington with a Plan B. On June 30, the Coalition Provisional Authority will be dissolved and the sovereignty of Iraq will be turned over to a US-backed transitional government. That government will be bound by an “interim constitution” (see March 8, 2004), which will contain a clause barring the transitional government from modifying any of Bremer’s laws. The lawsuit, filed on behalf of 9/11 victims’ relatives, accuses a number of individuals and organizations of funding and supporting al-Qaeda and thus helping the 9/11 attacks to occur. A number of Saudi princes are dropped because they work for the Saudi government. One judge writes in a ruling, “Whatever their actions, they were performed in their official (government) capacities.” According to the court ruling, only the US president, not the courts, has the authority to label a foreign nation as a terrorist supporter. Judges rule that the plaintiffs failed to provide sufficient facts to overcome the kingdom of Saudi Arabia’s immunity. Saudi defense minister Prince Sultan bin Abdul Aziz, Saudi ambassador to Britain Prince Turki al-Faisal, and Prince Mohammed Al-Faisal Al-Saud, among others, are dismissed from the lawsuit, but the lawsuit is allowed to proceed against many more defendants, including the Saudi Binladin Group, the multibillion dollar bin Laden family company. [Der Spiegel (Hamburg), 6/6/2005] The International Islamic Relief Organization (IIRO) is allowed to remain as a defendant, even though this charity has considerable ties to the Saudi government. [Source: Peter Bergen]Author and former war correspondent Peter Bergen writes that in the run-up to the Iraq war, most Americans believed wholeheartedly that Saddam Hussein and Iraq were behind the 9/11 attacks. Bergen writes: “[T]he belief that Saddam posed an imminent threat to the United States amounted to a theological conviction within the administration, a conviction successfully sold to the American public. So it’s fair to ask: Where did this faith come from?” One source is the American Enterprise Institute (AEI), a neoconservative think tank who has placed many of its fellows in the Bush administration, including Paul Wolfowitz, Richard Perle, and John Bolton. But, Bergen notes, none of the AEI analysts and writers are experts on either Iraq or the Middle East. None have ever served in the region. And most actual Middle East experts both in and out of government don’t believe that Iraq had any connection to the 9/11 attacks. The impetus for the belief in a 9/11-Iraq connection in part comes from neoconservative academic Laurie Mylroie.
Mylroie Supplies Neoconservatives with Desired Rationale - A noted author with an impressive academic resume, Mylroie, Bergen writes, “was an apologist for Saddam’s regime, but reversed her position upon his invasion of Kuwait in 1990, and, with the zeal of the academic spurned, became rabidly anti-Saddam.” In 1993, Mylroie decided that Saddam Hussein was behind the World Trade Center bombings, and made her case in a 2000 AEI-published book, Study of Revenge: Saddam Hussein’s Unfinished War Against America (see October 2000). Mylroie’s message was evidently quite popular with AEI’s neoconservatives. In her book, Mylroie blamed every terrorist event of the decade on Hussein, from the 1993 WTC bombings (a theory Bergen calls “risible”) to the 1996 crash of TWA Flight 800 into Long Island Sound (see July 17, 1996-September 1996), the 1998 embassy bombings in Tanzania and Kenya (see 10:35-10:39 a.m., August 7, 1998), the 2000 attack on the USS Cole (see October 12, 2000), and even the 1995 Oklahoma City bombings (see 8:35 a.m. - 9:02 a.m. April 19, 1995). Bergen calls her a “crackpot,” and notes that it “would not be significant if she were merely advising say, [conservative conspiracy theorist] Lyndon LaRouche. But her neocon friends who went on to run the war in Iraq believed her theories, bringing her on as a consultant at the Pentagon, and they seem to continue to entertain her eccentric belief that Saddam is the fount of the entire shadow war against America.”
Complete Discrediting - Bergen, after detailing how Mylroie ignored conclusive evidence that both the 1993 and 9/11 attacks were planned by al-Qaeda terrorists and not Saddam Hussein, quotes former CIA counterterrorism chief Vincent Cannistraro, who says Mylroie “has an obsession with Iraq and trying to link Saddam to global terrorism.” Cannistraro is joined by author and former CIA analyst Ken Pollack; Mary Jo White, the US attorney who prosecuted the 1993 WTC bombings and 1998 embassy attacks; and Neil Herman, the FBI official who headed the 1993 WTC investigation, who all dismiss Mylroie’s theories as absolutely baseless and thoroughly disproven by the evidence.
Belief or Convenience? - Apparently such thorough debunking did not matter to the AEI neoconservatives. Bergen writes that they were “formulating an alternative vision of US foreign policy to challenge what they saw as the feckless and weak policies of the Clinton administration. Mylroie’s research and expertise on Iraq complemented the big-think strategizing of the neocons, and a symbiotic relationship developed between them.” Whether the neoconservatives actually believed Mylroie’s work, or if “her findings simply fit conveniently into their own desire to overthrow Saddam,” Bergen isn’t sure. Perle later backed off of supporting Mylroie’s theories, calling them less than convincing and downplaying her role in developing arguments for overthrowing Hussein even as he suggests she should be placed in a position of power at the CIA. It is known that after 9/11, former CIA Director James Woolsey, a prominent neoconservative, went to Britain to investigate some of Mylroie’s claims (see Mid-September-October 2001). And in September 2003, Vice President Cheney called Iraq “the geographic base of the terrorists who have had us under assault for many years, but most especially on 9/11,” an echoing of Mylroie’s own theories. Mylroie’s latest book, Bush vs. the Beltway: How the CIA and the State Department Tried to Stop the War on Terror, accuses those agencies of suppressing information about Iraq’s role in 9/11, again contradicting all known intelligence and plain common sense (see July 2003).
Zeitgeist - Bergen concludes that in part because of Mylroie’s theories and their promulgation by Bush, Cheney, and prominent neoconservatives in and out of the administration, the US has been led into a disastrous war while 70 percent of Americans believe that Hussein had a role in the 9/11 attacks. “[H]er specious theories of Iraq’s involvement in anti-American terrorism have now become part of the American zeitgeist.” Perhaps the most telling statement from Mylroie comes from a recent interview in Newsweek, where she said: “I take satisfaction that we went to war with Iraq and got rid of Saddam Hussein. The rest is details.” Bergen retorts sourly, “Now she tells us.” [Washington Monthly, 12/2003; Unger, 2007, pp. 216]

A United Nations report criticizes Switzerland for failing to prevent support from reaching al-Qaeda and the Taliban. UN observers claim there is weapons smuggling passing through Switzerland to Afghanistan. The report further claims that the leaders of the banned Al Taqwa Bank (see November 7, 2001) are continuing to do business with new and renamed financial entities. They continue to maintain commercial interests and properties in Italy and Switzerland, despite being on US and UN blacklists. Switzerland is also failing to enforce travel bans. For instance, Al Taqwa leader Youssef Nada was able to travel through Switzerland to Liechtenstein and back in January 2003. [Swissinfo, 12/16/2003] Salon noted in 2002 that, for many years, Al Taqwa has benefited from political connections in Switzerland. Al Taqwa directors have ties to some European far right wing politicians such as French politician Jean-Marie Le Pen, and even neo-Nazi groups (see 1988). [San Francisco Chronicle, 3/12/2002; Salon, 3/15/2002] Newsweek will later report that in 2004, the UN will not convince its members to plug loopholes in the sanctions against Al Taqwa related entities. Instead, the UN Security Council will abolish its own monitoring group. [Newsweek, 3/3/2004; Newsweek, 12/24/2004] In late 2004, the Washington Post will report that although Al Taqwa “was supposedly shut down, US and European officials say they still find Nada moving funds under new corporate names.” [Washington Post, 9/11/2004] Additional reports of entities connected to Al Taqwa directors continuing to do business will appear in 2005 (see June-October 2005).

Among other topics addressed, he reaffirms his belief that terrorists operated in Iraq before the March 2003 invasion (citing Ansar al-Islam, “a al-Qaeda affiliate, I would call them al-Qaeda, was active in Iraq before the war, hence—a terrorist tie with Iraq…”) and that his insistence that Iraq had an active and threatening WMD program was based on “good solid intelligence[, t]he same intelligence that my predecessor [Bill Clinton] operated on.” [ABC News, 12/17/2003] In 2004, former Nixon White House counsel John Dean will respond, “His predecessor, however, never claimed that Saddam [Hussein] had imminent… nuclear capacity, nor did his predecessor say that Iraq had ties to al-Qaeda.” [Dean, 2004, pp. 153]
Iraq Had WMD Program, Bush Insists - Bush insists that weapons inspector David Kay proved Iraq did have a burgeoning and active WMD program (see October 2, 2003), and implies that it is just a matter of time before the actual weapons are found. Sawyer says, “But stated as a hard fact, that there were weapons of mass destruction as opposed to the possibility that he could move to acquire those weapons still,” to which Bush replies, “So what’s the difference?” Sawyer appears taken aback by the answer, and Bush continues that since it was possible Hussein would acquire WMDs, it was necessary to “get rid of him” to make “the world a safer, freer place.” Sawyer presses the point home: “What would it take to convince you he didn’t have weapons of mass destruction?” and Bush responds: “Saddam Hussein was a threat. And the fact that he is gone means America is a safer country.” Sawyer asks, “And if he doesn’t have weapons of mass destruction?” and Bush replies tartly: “Diane, you can keep asking the question. I’m telling you, I made the right decision for America. Because Saddam Hussein used weapons of mass destruction, invaded Kuwait (see August 2, 1990). Why Read the News? - Sawyer asks Bush about his reported penchant for not reading the news for himself. Bush confirms that he gets his news from National Security Adviser Condoleezza Rice and White House chief of staff Andrew Card, who, Sawyer says, “give you a flavor of what’s in the news.” Bush agrees that this is the case, and says: “Yeah. I get my news from people who don’t editorialize. They give me the actual news. And it makes it easier to digest, on a daily basis, the facts.” Sawyer asks, “Is it just harder to read constant criticism or to read?” to which Bush replies: “Why even put up with it when you can get the facts elsewhere? I’m a lucky man. I’ve got, it’s not just Condi and Andy. It’s all kinds of people in my administration who are charged with different responsibilities. And they come in and say, ‘this is what’s happening, this isn’t what’s happening.’” Laura Bush, who joins her husband halfway through the interview, says she reads the newspapers, including the opinion columns, but says: “I agree with him that we can actually get what is really happening from the people who really know what’s happening. And that isn’t always what you get in the newspapers.… There are certain columnists I won’t read. I mean, what, you know, why would I?” [ABC News, 12/17/2003]
Wilson: Bush 'Systematically Deceived' US, 'Betrayed' Military - Months later, former ambassador Joseph Wilson will write: “It was clear, from this one statement, […] that the administration, from the president on down, had systematically deceived the American people, Congress, and the world. Most of all, the president had betrayed the soldiers, sailors, airmen, and Marines who so bravely march out when ordered into war to defend our country against immiment threats, or even from grave and gathering dangers. Iraq had posed neither. The difference, Mr. President, I thought, is that war was not the only option, or even the best one. We had gone to war over capacity, not stockpiles, not mushroom clouds (see September 4, 2002), not intent, or, as John Bolton had earlier said more directly, because scientists were on Saddam’s payroll. Our troops had died—and were continuing to die—in vain. A truckload of about four thousand copies of the book “The FSB Blows Up Moscow” is seized by the FSB in order to protect “state secrets”. The book, by authors Alexander Litvinenko and Yuri Felshtinsky, claims the FSB orchestrated the 1999 apartment bombings (see September 22-24, 1999, September 9, 1999 and September 13, 1999). The bookseller calls it a “shock attack on freedom of the press in Russia” and suggests that “the fact that they opened the case under this part of the Criminal Code [on state secrets] is an indirect admission that they participated in the explosions.” [Agence France-Presse, 12/30/2003; Moscow Times, 1/30/2004]

The Los Angeles Times reports, “The implication of Khakamada’s accusations was that in both the 2002 theater crisis and the 1999 apartment bombings, authorities backing Putin may have wanted to see Russian citizens die and Chechen fighters painted as terrorists to boost support for military action in Chechnya and enhance the get-tough leader’s popularity.” Khakamada, a member of the anti-Putin Union of Right Forces party, says “there are a lot of suspicious things” about the 1999 apartment bombings and calls for an independent investigation. “This is a feature of real democracy, especially when it comes to investigations connected with actions of officials and special services,” she says. Vice President Dick Cheney tells Rocky Mountain News that a November 2003 article published in the conservative Weekly Standard (see November 14, 2003) represents “the best source of information” on cooperation between Iraq and al-Qaeda. The article was based on a leaked intelligence memo that had been written by Undersecretary of Defense for Policy Douglas Feith in 2002 and was the product of the Office of Special Plans (see August 2002). A private delegation of US negotiators and arms experts flies to Pyongyang for a demonstration of North Korea’s nuclear weapons program (see October 4, 2002 and January 10, 2003 and After). They tour the Yongbyon nuclear reactor, and see actual plutonium. Siegfried Hecker, a former director of the Los Alamos nuclear lab and one of the delegates, comes back to Washington convinced that North Korea has indeed processed all of its fuel rods. In testimony before the Senate Foreign Relations Committee, he tells the senators that while he saw no sign of actual weapons, that does not mean they do not have weapons, just that he was shown no evidence of such weapons. The 9/11 Commission first learns that the US had a program to assassinate Osama bin Laden before 9/11 (see December 24, 1998). The program, which is disclosed to the commission’s staff by former National Security Adviser Sandy Berger, was a response to the African embassy bombings (see 10:35-10:39 a.m., August 7, 1998). The commission was not previously aware of the order and when Berger tells them about it they are confused, because the CIA has been telling them there was no such order for months. When the commission tells Berger what the CIA has said, he assures them that there is an explicit document, a memorandum of notification concerning Afghanistan, that gives the CIA the authority to kill bin Laden, not just capture him. It is unclear why CIA managers repeatedly told the commission there was no such order (see Before January 14, 2004). [Shenon, 2008, pp. 253-254]

Alleged 9/11 mastermind Khalid Shaikh Mohammed (KSM) tells US interrogators that Abdul Hakim Murad, along with KSM a key conspirator in the Bojinka plot, only had a small role in the operation, according to the 9/11 Commission. The Commission will cite four intelligence reports, drafted on February 19 (two), February 24, and April 2, 2004, as the source of this claim. According to KSM, Murad’s only role in the plot was to courier $3,000 from Dubai to Manila. However, other evidence indicates Murad was much more significantly involved in the plot (see Before January 6, 1995 and January 6, 1995). The Commission will comment, “This aspect of KSM’s account is not credible, as it conflicts not just with Murad’s own confession [note: this may be unreliable as Murad was tortured (see After January 6, 1995)] but also with physical evidence tying Murad to the very core of the plot, and with KSM’s own statements elsewhere that Murad was involved in planning and executing the operation.” [9/11 Commission, 7/24/2004, pp. 489]

Faisal Gill.Faisal Gill. [Source: Salon]It is discovered that the Department of Homeland Security’s intelligence division policy director has disturbing associations with known radical militants. Faisal Gill, a White House political appointee with close ties to powerful Republican lobbyist Grover Norquist and no background in intelligence, failed to disclose on security clearance documents that he had worked with Abdurahman Alamoudi, a lobbyist with suspected terrorist ties. This is a potential felony. Jailed at the time, Alamoudi will be sentenced to 23 years in prison later in the year for plotting with Libyan agents to kill the de facto ruler of Saudi Arabia (see October 15, 2004). Gill is briefly removed from his job when his incorrect disclosures are discovered, but it is ultimately decided that he can keep his job. Salon notes that “Gill has access to top-secret information on the vulnerability of America’s seaports, aviation facilities, and nuclear power plants to terrorist attacks.” Gill previously worked in an organization tied to both Alamoudi and Norquist. One anonymous official says, “There’s an overall denial in the administration that the agenda being pushed by Norquist might be a problem. It’s so absurd that a Grover Norquist person could even be close to something like this. That’s really what’s so insidious.” Another official complains, “Who is Abdurahman Alamoudi? We really don’t know. So how can we say there is not a problem with his former aide?” [Salon, 6/22/2004]

The US-appointed Iraqi Interim Governing Council signs the Transitional Administrative Law (TAL), providing a timetable for the establishment of a representative government in Iraq. The TAL will serve as the country’s constitution during the transitional period, set to begin on June 30, 2004. On that date, the CPA will be dissolved and power will be transferred to a transitional government (This will actually happen on June 28; see June 28, 2004), which will rule Iraq until an elected government has been established. According to the TAL, the National Assembly will be elected in January 31, 2005 and charged with the task of writing a constitution that will be subjected to popular referendum no later than October 15, 2005. Finally, an elected government must be established no later than December 31, 2005. The TAL also includes provisions that place certain restrictions on the transitional government, such as one stating that all “laws, regulations, orders, and directives issued by the Coalition Provisional Authority” will remain in force during this period. An official with the Coalition Provisional Authority reports that the “CPA did not obtain the services of a certified public accounting firm as it was determined that these services were not those required.” UN Security Council Resolution 1483 (see May 22, 2003) required that the management of Iraq’s funds be “audited by independent public accountants approved by the International Advisory and Monitoring Board of the Development Fund for Iraq.” Similarly, the CPA’s Regulation Number 2 (see June 10, 2003) stated that it had to “obtain the services of an independent, certified public accounting firm.” Instead, the CPA hired North Star Consultants, Inc. (see October 2003), an obscure consulting firm, “to promote the effective administration of DFI Funds in a transparent manner for the benefit of the Iraqi people.” [US Congress, 2/6/2007 pdf file]

The International Atomic Energy Agency (IAEA) warns L. Paul Bremer, the head of the US-led Coalition Provisional Authority (CPA), that it is likely the huge explosives cache at the Al Qaqaa military facility in northern Babil Province has been looted (see May 2003). In October 2004, a senior Bush administration official will admit that securing the facility was not a major priority at the time; officials were far more concerned with the transfer of authority to an Iraqi government (see June 28, 2004). “It’s not an excuse,” says the official. “But a lot of things went by the boards.” In October 2004, the IAEA will inform the US that at least 380 tons of explosives from the Al Qaqaa cache have gone missing (see October 10, 2004 and October 25, 2004). A newspaper article reveals that Ptech, the Boston-based computer company with ties to Yassin al-Qadi and other suspected terrorist financiers (see 1994), is still continuing its business under a different name. The article states, “Although no one associated with the company has been charged, the US attorney’s office has never issued a statement exonerating the company or ending the investigation.” Ptech is now called GoAgile. The company lost many customers in the wake of the widely-publicized raid on its offices in 2002 (see December 5, 2002). WAMY logo. [Source: WAMY]US agents raid the US branch of World Assembly of Muslim Youth (WAMY), a large Saudi charity. The branch was founded in 1992 by Abdullah Awad bin Laden, a nephew of Osama, and he was still listed as president of the branch in a 2002 business listing. [Weekly Standard, 4/8/2002; Washington Post, 6/2/2004] In 1996, an FBI investigation into WAMY, Abdullah Awad, and his brother Omar, was closed down, apparently for political reasons (see February-September 11, 1996). At least two of the 9/11 hijackers lived about three blocks from WAMY’s office for much of 2001 (see March 2001 and After). A new investigation of WAMY was launched one week after 9/11 (see September 14-19, 2001). All of WAMY’s files and computer files are seized; one person is arrested on immigration charges. The raid appears to have taken place because WAMY came up in a terrorism investigation of the SAAR network (see March 20, 2002), located outside Washington and relatively close to the WAMY office. A federal affidavit alleges that WAMY has ties to Hamas. [Washington Post, 6/2/2004]

Ayatollah Sistani warns in a letter to the United Nations that the Security Council’s forthcoming resolution (see June 8, 2004) on the transfer of sovereignty to Iraq must not contain any references to the interim constitution known as the Transitional Administrative Law (see March 8, 2004) because that document “runs counter to the will of the Iraqi people.” Sistani writes: “This law, which has been written by an unelected council under the occupation and its direct influence, restricts the national [body] due to be elected at the beginning of the new year to draft Iraq’s permanent constitution. This runs against law and is rejected by the majority of the Iraqi people.” [Associated Press, 6/9/2004]

The United Nations Security Council unanimously passes Resolution 1546, formally transferring control of Iraq’s political and economic affairs to an interim government. While the resolution states that Iraq’s government has “full sovereignty,” the Iraqis will not have authority over the activities of the 160,000-strong US-led multinational force. Rather the resolution only states that the coalition forces have the right to “take all necessary measures to contribute to the maintenance of security and stability in Iraq,” albeit in a “security partnership” with the government. If the Iraqi government objects to a military operation in the country, its only option is to veto the participation of Iraqi personnel. This means, for example, that US and British forces retain the right to detain Iraqis, search homes, and respond to perceived threats employing whatever force they deem necessary, without approval from Iraq’s government. The French and Germans had proposed a provision that would have given the Iraqi government veto power over any military operations it objects to, but the US would not agree to it. The resolution does allow the Iraqi government to order the withdrawal of all international troops, however as observers have noted, given the current security situation, that is an unlikely scenario. [United Nations, 6/8/2004; New York Times, 6/9/2004] In spite of Kurdish demands, the resolution makes no references to Iraq’s interim constitution (see March 8, 2004), which Ayatollah Sistani has said is “counter to the will of the Iraqi people” (see June 8, 2004). The Kurds wanted the UN to affirm the validity of the interim constitution because it includes a clause that would give the Kurdish minority more leverage in crafting the country’s permanent constitution. Another provision in the constitution asserts that the interim government is bound by the laws passed under the authority of the Coalition Provisional Authority. However many Iraqis oppose the laws that were passed by the CPA because those laws made drastic changes to Iraq’s economic policy, opening it up to unrestricted foreign investment. The absence of any reference to the interim constitution in the resolution undermines the validity of the constitution and Bremer’s laws, according to some experts and officials. [New York Times, 6/9/2004] Main points of the resolution include:
bullet A national conference of political, religious, and tribal representatives shall convene in July to choose consultative counsels that will advise the interim government.
bullet Elections will be held for a transitional national assembly no later than January 31, 2005. The assembly will form a transitional government, which will draft a permanent constitution. Iraqis will then have elections for a full-term government no later than December 31, 2005.
bullet The multinational force in Iraq will help the Iraqi government recruit, train, and equip Iraqi security forces.
bullet The Iraqi government has sole authority for the disbursement of oil and gas revenues.
bullet The interim government must refrain “from taking any actions affecting Iraq’s destiny.”
bullet The UN mandate for the multinational force will expire after elections are held under a new constitution; however the council “will terminate this mandate earlier if requested by the government of Iraq.”
The resolution is the product of two weeks of negotiation, undergoing five revisions. The original draft was submitted on May 24. [Associated Press, 6/8/2003] On at least one occasion during this process, the Iraqi Governing Council had complained that its views were not being adequately represented in the Security Council. In one statement, the governing council said they wanted to discuss full Iraqi control of “the activities of the Iraqi armed forces and security forces.” The council also objected to any moves to grant foreign soldiers immunity from prosecution under Iraqi law. [Associated Press, 5/25/2003] Though the resolution’s final context contains no such provision, Paul Bremer will sign an extension (see June 27, 2004) to Order 17, which granted US personnel and contractors immunity from prosecution by the Iraq government.
