When asked in a press conference if the success of the “war on terrorism” has been overstated, Senate Majority Leader Tom Daschle (D-SD) replies: “I don’t think the success has been overstated. But the continued success I think is still somewhat in doubt.… I will say that at this point, given the information we’ve been provided, I don’t think it would do anybody any good to second-guess what has been done to date. I think it has been successful. I’ve said that on many, many occasions. But I think the jury’s still out about future success, as I’ve said.” He adds that it would be necessary for the US to find Osama bin Laden and other al-Qaeda leaders for the “war on terrorism” to be considered a success. But despite the mild tone of these comments, Senate Minority Leader Trent Lott (R-MS) responds by saying: “How dare Senator Daschle criticize President Bush while we are fighting our war on terrorism, especially when we have troops in the field. He should not be trying to divide our country while we are united.” Senator Bill Frist (R-TN) calls Daschle’s remarks “thoughtless and ill-timed.” And Representative Tom Davis (R-VA) uses language analogous to a charge of treason, saying that that Daschle’s “divisive comments have the effect of giving aid and comfort to our enemies by allowing them to exploit divisions in our country.” [Salon, 3/1/2002] Secretary of State Colin Powell defends Daschle and other Democrats, saying: “They’re raising questions. And I think that’s what a loyal opposition does.”
The Washington Post editorial board criticizes the Republican response, saying that the US “would be a weaker country if Sen. Lott succeed[s] in choking off debate.” But Lott refuses to apologize, and says that “any sign that we are losing that unity, or crack in that support, will be, I think, used against us overseas.” [New York Times, 3/1/2002; Salon, 3/5/2002]

[Source: Americans for Truth about Homosexuality (.com)]Recent remarks by Senator Rick Santorum (R-PA) alleging that granting rights to homosexuals would also grant Americans the right to commit incest, child rape, and bestiality (see April 7, 2003) draw heavy criticism from both pro-gay organizations and political opponents. Winnie Stachelberg of the gay advocacy organization Human Rights Campaign says: “Senator Santorum’s remarks are deeply hurtful and play on deep-seated fears that fly in the face of scientific evidence, common sense, and basic decency. Clearly, there is no compassion in his conservatism.” Stachelberg asks Republican Congressional leaders to repudiate Santorum’s remarks. The Democratic Senatorial Campaign Committee (DSCC) calls on Santorum to resign as chairman of the Republican Senate Caucus, the number three position in the GOP leadership; Santorum does not do so. The DSCC’s Brad Woodhouse says, “Senator Santorum’s remarks are divisive, hurtful, and reckless and are completely out of bounds for someone who is supposed to be a leader in the United States Senate.” Senate Minority Leader Tom Daschle (D-SD) says Santorum’s position is “out of step with our country’s respect for tolerance.” Senator John Kerry (D-MA), a Democratic presidential contender, criticizes the White House for not speaking out against Santorum’s statements, saying, “The White House speaks the rhetoric of compassionate conservatism, but they’re silent while their chief lieutenants make divisive and hurtful comments that have no place in our politics.” Democratic presidential contender Howard Dean (D-VT) joins in calls for Santorum to step down from the RSC post, saying: “Gay-bashing is not a legitimate public policy discussion; it is immoral. Rick Santorum’s failure to recognize that attacking people because of who they are is morally wrong makes him unfit for a leadership position in the United States Senate. Today, I call on Rick Santorum to resign from his post as Republican Conference chairman.” Patrick Guerriero of the Republican pro-gay group, the Log Cabin Republicans, says that Santorum should either apologize or step down from his post as RSC chair: “If you ask most Americans if they compare gay and lesbian Americans to polygamists and folks who are involved in incest and the other categories he used, I think there are very few folks in the mainstream who would articulate those views.” Santorum’s remarks make it difficult to characterize the GOP as inclusive, Guerriero adds. [CNN, 4/23/2003; CNN, 4/23/2003] Guerriero later tells a gay advocacy newspaper: “Log Cabin Republicans are entering a new chapter. We’re no longer thrilled simply about getting a meeting at the White House. We’re organized enough to demand full equality. I’ve heard that vibration since I’ve been in Washington—that people in the party are taking us for granted. To earn respect, we have to start demanding it.… One of the most disappointing things about this episode is that we’ve spent a lot of time with the senator trying to find common ground. This is how he repays us? There is a sad history of Republican leaders choosing to go down this path, and he should’ve known better.” Another, less prominent Republican pro-gay organization, the Republican Unity Coalition, denounces Santorum’s views but stands by his right to hold them. [The Advocate, 6/10/2003] Some Republican senators join in criticizing Santorum. Susan Collins (R-ME) says Santorum’s choice of words is “regrettable” and his legal analysis “wrong.” Olympia Snowe (R-ME) says, “Discrimination and bigotry have no place in our society, and I believe Senator Santorum’s remarks undermine Republican principles of inclusion and opportunity.” Lincoln Chafee (R-RI) says: “I thought his choice of comparisons was unfortunate and the premise that the right of privacy does not exist—just plain wrong. Senator Santorum’s views are not held by this Republican and many others in our party.” Gordon Smith (R-OR) says that “America and the Republican Party” no longer equate “sexual orientation with sexual criminality. While Rick Santorum intended to reiterate the language of an old Supreme Court decision, he did so in a way that was hurtful to the gay and lesbian community.” And John McCain (R-AZ) says: “I think that he may have been inartful in the way that he described it. I believe that—coming from a person who has made several serious gaffes in my career—that the best thing to do is to apologize if you’ve offended anyone. Because I’m sure that Rick did not intend to offend anyone. Apologize if you did and move on.” [Salon, 4/26/2003] The only openly gay member of the House of Representatives, Barney Frank (D-MA), says of Santorum: “The only surprise is he’s being honest about it. This kind of gay bashing is perfectly acceptable in the Republican Party.” Kim Gandy, president of the National Organization for Women (NOW), calls Santorum’s remarks “stunning” and adds: “Rick Santorum is afflicted with the same condition as Trent Lott—a small mind but a big mouth. [Gandy is referring to Lott’s forcible removal from his position as Senate majority leader in 2002 after making pro-segregation remarks.] He has refused to apologize and Republican leaders have either supported or ignored Santorum’s rants blaming societal ills on feminists, liberals, and particularly gays and lesbians. Far from being a compassionate conservative, Santorum’s lengthy and specific comments expose him as abusive, intolerant, and downright paranoid—a poor combination for a top Senate leader.” [People's World, 5/7/2003]
Santorum: AP Story 'Misleading' - Santorum says the Associated Press story reporting his remarks was “misleading,” and says he was speaking strictly about a recent Supreme Court case striking down a Texas anti-sodomy law. “I am a firm believer that all are equal under the Constitution,” he says. “My comments should not be construed in any way as a statement on individual lifestyles.” When questioned by a gay Pennsylvanian about his remarks, he says his words were “taken out of context.” (The questioner says to Santorum: “You attacked me for who I am.… How could you compare my sexuality and what I do in the privacy of my home to bigamy or incest?” Santorum denies being intolerant of homosexuality, but repeats his stance that if states were not allowed to regulate homosexual activity in private homes, “you leave open the door for a variety of other sexual activities to occur within the home and not be regulated.”) However, CNN reports that, according to unedited excerpts of the audiotaped interview, “Santorum spoke at length about homosexuality and he made clear he did not approve of ‘acts outside of traditional heterosexual relationships.’ In the April 7 interview, Santorum describes homosexual acts as a threat to society and the family. ‘I have no problem with homosexuality,’ Santorum said, according to the AP. ‘I have a problem with homosexual acts.’” [CNN, 4/23/2003; CNN, 4/23/2003] In an interview on Fox News, Santorum says: “I do not need to give an apology based on what I said and what I’m saying now—I think this is a legitimate public policy discussion. These are not, you know, ridiculous, you know, comments. These are very much a very important point.… I was not equating one to the other. There is no moral equivalency there. What I was saying was that if you say there is an absolute right to privacy for consenting adults within the home to do whatever they want, [then] this has far-reaching ramifications, which has a very serious impact on the American family, and that is what I was talking about.… I am very disappointed that the article was written in the way it was and it has been construed the way it has. I don’t believe it was put in the context of which the discussion was made, which was rather a far-reaching discussion on the right to privacy.” [Salon, 4/26/2003; Fox News, 4/28/2003]
Bush Defends Santorum - After three days of remaining silent, President Bush issues a brief statement defending Santorum’s remarks, calling Santorum “an inclusive man.” In response, the Democratic National Committee (DNC) issues the following statement from chairman Terry McAuliffe: “President Bush is awfully selective in which American values he chooses to comment on. Rick Santorum disparaged and demeaned a whole segment of Americans and for that President Bush praises him. Three young women in the music business expressed their views and it warrants presidential action. I would suggest that rather than scold the Dixie Chicks (see March 10, 2003 and After), President Bush would best serve America by taking Rick Santorum to the woodshed.” [People's World, 5/7/2003; The Advocate, 6/10/2003]
Other Support - Some senators come to Santorum’s defense. Senate Majority Leader Bill Frist (R-TN) says in a statement, “Rick is a consistent voice for inclusion and compassion in the Republican Party and in the Senate, and to suggest otherwise is just politics.” Senator Charles Grassley (R-IA) blames the media for the controversy, saying: “He’s not a person who wants to put down anybody. He’s not a mean-spirited person. Regardless of the words he used, he wouldn’t try to hurt anybody.… We have 51 Republicans [in the Senate] and I don’t think anyone’s a spokesman for the Republican Party. We have a double standard. It seems that the press, when a conservative Republican says something, they jump on it, but they never jump on things Democrats say. So he’s partly going to be a victim of that double standard.” Santorum’s Pennsylvania colleague, Senator Arlen Specter (R-PA), says, “I have known Rick Santorum for the better part of two decades, and I can say with certainty he is not a bigot.” Asked if Santorum’s comments will hurt his re-election prospects, Specter says: “It depends on how it plays out. Washington is a town filled with cannibals. The cannibals devoured Trent Lott without cause. If the cannibals are after you, you are in deep trouble. It depends on whether the cannibals are hungry. My guess is that it will blow over.” Senator Jim Bunning (R-KY) says, “Rick Santorum has done a great job, and is solid as a rock, and he’s not going anywhere.” A number of Republican senators, including Jim Kolbe (R-AZ), the only openly gay Republican in Congress, refuse to comment when asked. [Salon, 4/26/2003] Gary Bauer, a powerful activist of the Christian Right who ran a longshot campaign for the Republican presidential nomination in 2000, says that “while some elites may be upset by [Santorum’s] comments, they’re pretty much in the mainstream of where most of the country is.” [The Advocate, 6/10/2003] The conservative advocacy group Concerned Women for America says Santorum was “exactly right” in his statements and blames what it calls the “gay thought police” for the controversy. Genevieve Wood of the Family Research Council agrees, saying, “I think the Republican Party would do well to follow Senator Santorum if they want to see pro-family voters show up on Election Day.” [CNN, 4/23/2003] Joseph Farah, the publisher of the conservative online news blog WorldNetDaily (WND), says that Santorum was the victim of a “setup” by the Associated Press, and Lara Jakes Jordan, the reporter who wrote the story should be fired. Santorum’s remarks “were dead-on target and undermine the entire homosexual political agenda,” Farah writes. “Santorum articulated far better and more courageously than any elected official how striking down laws against sodomy will lead inevitably to striking down laws against incest, bigamy, and polygamy. You just can’t say consenting adults have an absolute right to do what they want sexually without opening that Pandora’s box.” He accuses the AP of launching what he calls a “hatchet job” against Santorum, designed to take down “a young, good-looking, articulate conservative in the Senate’s Republican leadership.” The AP reporter who interviewed Santorum, Lara Jakes Jordan, is, he says, “a political activist disguised as a reporter.” Farah notes that Jordan is married to Democratic operative Jim Jordan, who works for the Kerry campaign, and in the past Jordan has criticized the AP for not granting benefits to gay domestic partners. Thusly, Farah concludes: “It seems Mrs. Jordan’s ideological fervor is not reserved only for her private life and her corporate politicking. This woman clearly ambushed Santorum on an issue near and dear to her bleeding heart.” [WorldNetDaily, 4/28/2003]

Dennis Hastert. [Source: Cleveland Leader]Congressional Republicans join in the White House attempt to recover its credibility on the Iraq-Niger uranium affair (see February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003) by attacking critics. Days earlier, President Bush met with House Speaker Dennis Hastert (R-IL) and Senate Majority Leader Bill Frist (R-TN). Hastert said that Bush needed a stronger defense against criticism, and both men told Bush they and other Congressional leaders were ready to help. Hastert now says that Bush’s critics “want to be president” and are out “to hurt the credibility of the president, to throw mud and see what sticks.” Frist cites the “relative silence in the press about the conditions on the ground” in Iraq “in terms of progress, in terms of improvement.” [Associated Press, 7/22/2003]
On February 2, 2004, the deadly toxin ricin is detected on an automatic mail sorter in the Senate office building mailroom that serves the office of Senate Majority Leader Bill Frist (R-TN). Subsequent tests confirm the substance is ricin. No one gets ill. Some buildings are closed, but Senate business continues as usual. It is presumed that the ricin arrived in a letter, but the letter is not found, leaving few clues. [CNN, 2/4/2004] About two months later, it is reported that laboratories are continuing to analyze the ricin in an attempt to determine where it came from, but no suspects or likely motives have been identified. In October 2004, two letters were intercepted in South Carolina and Tennessee containing real ricin. Letters were found with the ricin objecting to new rules for truckers. One letter was intended to go to the Department of Transportation and another to the White House. But it is unknown if there is any connection between those letters and the ricin in Frist’s office, although Frist represents Tennessee. It is also unknown if there is any connection to the 2001 anthrax attacks (see October 5-November 21, 2001). According to the Associated Press, “Unlike anthrax spores, ricin requires little scientific training to engineer and is not nearly as dangerous to handle.” [Associated Press, 3/31/2005]
White House counsel Alberto Gonzales works on questions that are to be put later in the day by the 9/11 Commission to former counterterrorism “tsar” Richard Clarke (see March 24, 2004). Clarke has recently gone public with criticisms of the Bush administration and is being attacked by it (see March 21, 2004, March 22, 2004 and Shortly After, and March 24, 2004). The questions are supplied to two Republican commissioners, Fred Fielding and Jim Thompson, who author Philip Shenon will say “were seen as the administration’s most reliable supporters on the Commission.” Some of these questions may actually be asked at the hearing, and Shenon will add, “During Clarke’s testimony, Fielding and Thompson could be seen standing up from the dais periodically and disappearing to a back room to take phone calls, apparently from the White House.” [Shenon, 2008, pp. 280] When the communications between the White House and the commissioners come to light after the hearing, critics will call it unethical interference in the hearings. [Washington Post, 4/1/2004] For example, Democratic commissioner Bob Kerrey complains, “To call commissioners and coach them on what they ought to say is a terrible mistake.” [New York Daily News, 4/2/2004] In addition to the questions for the commissioners, according to Shenon, Gonzales is in contact with the office of Senator Bill Frist, the Republican majority leader, and Frist is “prepared to rush to the Senate floor to denounce Clarke and question his truthfulness as soon as the hearing was over.” [Shenon, 2008, pp. 280] Frist will soon ask “[i]f [Clarke] lied under oath to the United States Congress” in closed testimony in 2002. The White House discloses to Fox News that former counterterrorism “tsar” Richard Clarke was the anonymous official who gave a background briefing to reporters in August 2002 praising the Bush administration’s record on terrorism (see August 22, 2002). This move, which violates a longstanding confidentiality policy, is made hours before Clarke is to testify to the 9/11 Commission (see March 24, 2004). Clarke recently went public with criticism of the administration (see March 21, 2004) and is being attacked by it (see March 22, 2004 and Shortly After). Author Philip Shenon will comment, “In agreeing to allow Fox News to reveal that Clarke had given the 2002 briefing, the White House was attempting to paint him as a liar—a one-time Bush defender who had become a Bush critic in order to sell a book.” National Security Adviser Condoleezza Rice says to the media: “There are two very different stories here. These stories can’t be reconciled.” [Fox News, 3/24/2004; Washington Post, 3/25/2004; Washington Post, 3/26/2004; Shenon, 2008, pp. 280-281]
Opposing Spin? - Shenon will add that in the briefing Clarke was “spin[ning] the facts” in order to try to knock down an article unfavorable to the administration published by Time magazine, although “the spin took him perilously close to dishonesty, albeit the sort of dishonesty practiced every day in official Washington.” Philip Zelikow, the 9/11 Commission’s executive director and a long-term opponent of Clarke (see January 3, 2001 and January 27, 2003), is delighted by the story and tells a Commission staffer that it might be enough to end the Clarke “circus,” adding, “Does it get any better than this?” [Shenon, 2008, pp. 280-281] Later trying a similar line of attack, Republican Senate leader Bill Frist will ask “[i]f [Clarke] lied under oath to the United States Congress” in closed testimony in 2002, and also ask if Clarke is attempting to promote his book. According to media critic Frank Rich, Frist’s credibility is undermined by his use of his Senate status to promote his own book, a virtually worthless primer entitled When Every Moment Counts: What You Need to Know About Bioterrorism from the Senate’s Only Doctor. Frist’s accusation that Clarke revealed classified information in his book falls flat when Clarke notes that the White House vetted his book for possible security transgressions before publication. No Evidence of Contradiction - A review of declassified citations from Clarke’s 2002 testimony provides no evidence of contradiction, and White House officials familiar with the testimony agree that any differences are matters of emphasis, not fact. [Washington Post, 4/4/2004]
Senate Minority Leader Harry Reid (D-NV) calls upon the White House to strip political adviser Karl Rove of his security clearance, referring to Rove’s involvement in leaking the CIA identity of Valerie Plame Wilson (see July 10, 2005). Reid says that the administration should have done so long ago, but instead has refused to discuss Rove’s involvement and attacked its critics. “This is what is known as a cover-up,” Reid says. “This is an abuse of power.” In response, Senate Majority Leader Bill Frist (R-TN) accuses Democrats of resorting to “partisan war chants.” [Associated Press, 7/15/2005] Shortly after Reid’s statement, the progressive media watchdog organization Media Matters notes that Rove has, apparently, violated the strictures of the federal government’s Classified Information Nondisclosure Agreement (Standard Form 312), and that those strictures call for the removal of Rove’s security clearance. The organization goes on to note that with few exceptions, the mainstream media has repeated Democratic calls for Rove to lose his clearance without mentioning Rove’s violation of the Nondisclosure Agreement. According to the Agreement, “dissemination” or “confirmation” of classified information constitutes an “unauthorized disclosure,” even after that information has been published in a “public source.” [Media Matters, 7/19/2005] In October, Rove will admit to having leaked Plame Wilson’s name to two reporters (see October 14, 2005).
Senator John McCain (R-AZ) introduces an amendment to the annual legislation to fund the Defense Department. McCain’s amendment, co-sponsored by Senate Armed Services Committee chairman John Warner (R-VA) and Senator Lindsey Graham (R-SC), a former military lawyer, states that military interrogators cannot exceed the limits on detainee treatment set forth in the US Army Field Manual. In essence, the amendment would prohibit the use of harsh interrogation techniques that many, including McCain, feel constitute torture. The Field Manual limits were specifically written to comply with the Geneva Conventions. The amendment also prohibits US officials, including CIA agents, from inflicting not just torture but any form of “cruel, inhuman, and degrading treatment” on anyone in their custody, no matter where in the world the prisoner is being kept. The amendment, later known as the McCain Amendment or the McCain Torture Ban, becomes the subject of fierce, largely private negotiations between McCain and the White House. Vice President Cheney quickly lobbies friendly Republicans in Congress to oppose the amendment, and has private meetings with Warner and McCain. At Cheney’s behest, Senate Majority Leader Bill Frist (R-TN) withdraws the entire bill from consideration rather than allow it to pass with the McCain amendment attached. [Savage, 2007, pp. 220-221]
Congressional Republicans jump-start the process to renew the 1965 Voting Rights Act (VRA—see August 6, 1965 and June 29, 1989) in what media and political observers believe is an effort to outflank Democrats, who are traditionally the most staunch supporters of the bill. Key portions of the bill are set to expire in 2007, including Section 5, which requires that states, districts, and other locales with a history of racial discrimination in their electoral processes get Justice Department approval before making any changes to voting procedures. Section 5 is intended to ensure that minorities are not disenfranchised due to their race. Observers believe Republicans want to avoid a showdown over the bill in light of the upcoming midterm elections in 2006. In 1982, the Reagan administration fought Congressional Democrats over an expansion of the law, and Republicans want to make sure that scenario does not play itself out again as the midterm elections approach. Republicans also want to reach out to African-American voters, traditionally a strong Democratic voting bloc. Representative John Lewis (D-GA), a veteran of the civil rights struggle, says, “I’m not surprised at all” that Republicans want to renew the VRA and reach out to black voters. “The Republicans are reaching out to the African-American voters.… They want to make a dent with the black electorate, take some of those voters away from the Democratic side.” Lewis intends to insert language into the renewal bill that would invalidate a recent Georgia law requiring photo identification for prospective voters, a requirement he and many others say would discriminate against the poor and the elderly. Representative James Sensenbrenner (R-WI) broke with recent Republican tradition by calling on Congress to renew Section 5 and other portions of the VRA at the NAACP’s annual convention in July. “I am here to tell you publicly what I have told others privately, including the head of the Congressional Black Caucus, Rep. Mel Watt,” Sensenbrenner told the assemblage. “During this Congress we are going to extend the Voting Rights Act. We cannot let discriminatory practices of the past resurface to threaten future gains. The Voting Rights Act must continue to exist—and exist in its current form.” Sensenbrenner said at the convention that House Speaker Dennis Hastert (R-IL) considers renewal of the VRA “high on his list of issues the House will address this Congress.” A representative for Senate Majority Leader Bill Frist (R-TN) says Frist is “fired up” over renewal of Section 5. Only a few months ago, Bush appeals court nominee William Pryor, a Republican from Alabama, called Section 5 “an affront to federalism and an expensive burden that has far outlived its usefulness,” a controversial characterization that Senator Saxby Chambliss (R-GA) and other Republicans defended. In May, Attorney General Alberto Gonzales suggested that the Bush administration is not fully behind reauthorization of Section 5. Political observers say that Democrats intend to use any further Republican opposition to the VRA to claim that Republicans are insensitive to black voters, even as senior Republican strategists like Republican National Committee Chairman Ken Mehlman say they want the party to appeal to that demographic. Mehlman told the NAACP convention in July that Republican leaders had tried over the past 40 years “to benefit politically from racial polarization.” He then said, “We were wrong” to do so. Senator Russell Feingold (D-WI) tells reporters that he intends to push through legislation that would censure President Bush because of his domestic surveillance program (see February 2001, Spring 2001, After September 11, 2001, After September 11, 2001, October 2001, Early 2002, September 2002, Late 2003-Early 2004, April 19-20, 2004, June 9, 2005, June 9, 2005, December 15, 2005, December 17, 2005, December 19, 2005, December 24, 2005, January 5, 2006, January 18, 2006, January 18, 2006, January 23, 2006, and January 30, 2006). “What the president did by consciously and intentionally violating the Constitution and laws of this country with this illegal wiretapping has to be answered,” Feingold tells an interviewer. “Proper accountability is a censuring of the president, saying, ‘Mr. President, acknowledge that you broke the law, return to the law, return to our system of government.‘… The president has broken the law and, in some way, he must be held accountable.… Congress has to reassert our system of government, and the cleanest and the most efficient way to do that is to censure the president. And, hopefully, he will acknowledge that he did something wrong.” Senate Majority Leader Bill Frist (R-TN) calls Feingold’s proposal “a crazy political move.” The Senate Intelligence Committee, following the Bush administration’s lead, has rejected some Democrats’ call for a full investigation of the surveillance program (see February 1-6, 2006). Instead, the committee has adopted a Republican plan for a seven-member subcommittee to conduct oversight. Feingold says his censure motion is not “a harsh approach, and it’s one that I think should lead to bipartisan support.” Frist, however, says: “I think it, in part, is a political move because here we are, the Republican Party, the leadership in the Congress, supporting the president of the United States as commander in chief who is out there fighting al-Qaeda and the Taliban and Osama bin Laden and the people who have sworn—have sworn—to destroy Western civilization and all the families listening to us.… The signal that it sends that there is in any way a lack of support for our commander in chief who is leading us with a bold vision in a way that we know is making our homeland safer is wrong. And it sends a perception around the world.” Only once in history has a president been censured by Congress: Andrew Jackson in 1834. In the House, Representative John Conyers (D-MI) is exploring the idea of introducing impeachment legislation against Bush. [New York Times, 3/12/2006; Associated Press, 3/12/2006] Feingold says on the Senate floor: “The president has violated the law and Congress must respond. A formal censure by Congress is an appropriate and responsible first step to assure the public that when the president thinks he can violate the law without consequences, Congress has the will to hold him accountable.” Most Congressional Democrats want nothing to do with either Feingold’s or Conyers’s legislative ideas, and some Republicans seem to be daring Democrats to vote for the proposal. Vice President Dick Cheney tells a Republican audience in Feingold’s home state of Wisconsin, “Some Democrats in Congress have decided the president is the enemy.” Democratic leaders in the Senate thwart an immediate vote as requested by Frist, and Senator Richard Durbin (D-IL) says he is not sure the proposal will ever come to a vote. Senate Minority Leader Harry Reid (D-NV) says he does not support it and has not read it. Senator Joseph Lieberman (D-CT) makes a similar assertion. In the House, Minority Leader Nancy Pelosi (D-CA) refuses to support such a proposal, saying in a statement that she “understands Senator Feingold’s frustration that the facts about the NSA domestic surveillance program have not been disclosed appropriately to Congress. Both the House and the Senate must fully investigate the program and assign responsibility for any laws that may have been broken.” [Associated Press, 3/14/2006] Former Nixon aide John Dean testifies in support of Feingold’s censure motion (see March 31, 2006). However, the censure motion, lacking support from Democratic leaders and being used by Republicans as a means to attack Democrats’ patriotism, never comes to a vote. [Klein, 2009, pp. 84]

New documents contradict Attorney General Alberto Gonzales’s recent sworn testimony before the Senate Judiciary Committee, indicating that Gonzales may have committed perjury before the panel.
Lied About Congressional Briefing - In testimony before the committee (see July 24, 2007), Gonzales told senators that a March 10, 2004 emergency briefing with the so-called “Gang of Eight,” comprised of the Republican and Democratic leaders of the two houses of Congress and the ranking members of both houses’ intelligence committees (see March 10, 2004), did not concern the controversial NSA warrantless domestic surveillance program, but instead was about other surveillance programs which he was not at liberty to discuss. But according to a four-page memo from the national intelligence director’s office, that briefing was indeed about the so-called “Terrorist Surveillance Program,” or TSP, as it is now being called by White House officials and some lawmakers. The memo is dated May 17, 2006, and addressed to then-Speaker of the House Dennis Hastert. It details “the classification of the dates, locations, and names of members of Congress who attended briefings on the Terrorist Surveillance Program,” wrote then-Director of National Intelligence John Negroponte. The DNI memo provides further evidence that Gonzales has not been truthful in his dealings with Congress, and gives further impetus to a possible perjury investigation by the Senate. So far, both Gonzales and Justice Department spokesmen have stood by his testimony. The nature of the March 2004 briefing is important because on that date, Gonzales and then-White House chief of staff Andrew Card tried to pressure then-Attorney General John Ashcroft, while Ashcroft was recuperating from emergency surgery in the hospital, to reauthorize the domestic wiretapping program over the objections of acting Attorney General James Comey, who had refused to sign off on the program due to its apparent illegality (see March 10-12, 2004). Comey’s own testimony before the Senate has already strongly contradicted Gonzales’s earlier testimonies and statements (see May 15, 2007). The entire imbroglio illustrates just how far from legality the NSA wiretapping program may be, and the controversy within the Justice Department it has produced. Gonzales flatly denied that the March 2004 briefing was about the NSA program, telling the panel, “The dissent related to other intelligence activities. The dissent was not about the terrorist surveillance program.”
Grilled By Senators - Senator Charles Schumer (D-NY) pressed Gonzales for clarification: “Not the TSP? Come on. If you say it’s about other, that implies not. Now say it or not.” Gonzales replied, “It was not. It was about other intelligence activities.” Today, with the DNI documents in hand, Schumer says, “It seemed clear to just about everyone on the committee that the attorney general was deceiving us when he said the dissent was about other intelligence activities and this memo is even more evidence that helps confirm our suspicions.” Other senators agree that Gonzales is not telling the truth. “There’s a discrepancy here in sworn testimony,” says committee chairman Patrick Leahy (D-VT). “We’re going to have to ask who’s telling the truth, who’s not.” And committee Democrats are not the only ones who find Gonzales’s testimony hard to swallow. Arlen Specter (R-PA) told Gonzales yesterday, “I do not find your testimony credible, candidly.” The “Gang of Eight” members disagree about the content of the March briefing. Democrats Nancy Pelosi, Jay Rockefeller, and Tom Daschle all say Gonzales’s testimony is inaccurate, with Rockefeller calling Gonzales’s testimony “untruthful.” But former House Intelligence chairman Porter Goss and former Senate Majority Leader Bill Frist, both Republicans, refuse to directly dispute Gonzales’s claims. Manuel Miranda. [Source: Wall Street Journal]Departing State Deartment employee Manuel Miranda, a longtime Republican operative in the Office of Legislative Statecraft who has served in the US Embassy in Baghdad for the last year, writes a memo to US Ambassador Ryan Crocker saying that the State Department’s efforts in Iraq are so poorly managed they “would be considered willfully negligent if not criminal” if done in the private sector. “We have brought to Iraq the worst of America—our bureaucrats,” Miranda writes in the memo, which is cc’d to “ALCON” or “all concerned” at the State Department. “You are doing a job for which you are not prepared as a bureaucracy or as leaders. The American and Iraqi people deserve better.” The US will never win the confidence of the Iraqi people as long as the State Department and the Foreign Service are in control, Miranda writes. Their members are hard-working and willing, he observes, but in his judgment are ill-prepared and incompetent. Instead of a streamlined, efficient management team, Miranda says, the occupation’s civilian governance has been little more than a never-ending battle for bureaucratic control between different agencies and different factions within the same department. He accuses the Foreign Service of suffering from “attention deficit disorder.” “Any American graduate-school study group could do better,” he avers. The State Department responds: “We think Ambassador Crocker and his team are doing a very good job under extremely challenging circumstances. We have great confidence in their ability to carry out their mission.” Miranda is a former legal counsel for then-Senate Majority Leader Bill Frist (R-TN), and was involved in a controversy after he hacked into Senate Democrats’ Capitol Hill computer system, stole a private political strategy memo, and leaked it to the press.
