“Wolfowitz seized the opportunity. Attacking Afghanistan would be uncertain. He worried about 100,000 American troops bogged down in mountain fighting in Afghanistan six months from then. In contrast, Iraq was a brittle, oppressive regime that might break easily. It was doable. He estimated that there was a 10 to 50 percent chance Saddam was involved in the September 11 terrorist attacks. The US would have to go after Saddam at some time if the war on terrorism was to be taken seriously.” [Woodward, 2002, pp. 83]
Three attorneys—one the assistant attorney general of Tennessee, Alex Shipley—are asked to work as so-called “agent provocateur” for the Campaign to Re-elect the President (CREEP), an organization working to re-elect President Nixon (see October 10, 1972). The three tell their story to Washington Post reporter Carl Bernstein in late September 1972, and Bernstein’s colleague Bob Woodward learns more from his FBI source, “Deep Throat,” days later (see October 7, 1972 and October 9, 1972). They all say they were asked to work to undermine the primary campaigns of Democratic presidential candidates by the same man, Donald Segretti, a former Treasury Department lawyer who lives in California. Segretti will later be identified as a CREEP official. Segretti, the attorneys will say, promises them “big jobs” in Washington after Nixon’s re-election (see November 7, 1972). All three says they rejected Segretti’s offers (see June 27-October 23, 1971). Segretti himself will deny the allegations, calling them “ridiculous.”
Part of a Larger Pattern? - Bernstein and Woodward connect the Segretti story to other Nixon campaign “dirty tricks” they are already aware of, including efforts by Watergate burglar James McCord (see June 19, 1972) to “investigate” reporter Jack Anderson, attempts by Watergate surveillance man Alfred Baldwin (see June 17, 1972) to infiltrate Vietnam Veterans Against the War, Watergate burglar E. Howard Hunt’s successful attempts to electronically “bug” Democratic campaign headquarters (see May 27-28, 1972) and his investigation of Democratic presidential candidate Edward Kennedy (see June 19, 1972), and McCord’s rental of an office next to the offices of Democratic presidential candidate Edmund Muskie. To the reporters, the Segretti story opens up speculation that the Nixon campaign had undertaken political espionage efforts long before the Watergate burglary. In their book All the President’s Men, Bernstein and Woodward write, “Watergate could have been scheduled before the president’s re-election chances looked so good and perhaps someone had neglected to pull the plug.” Bernstein has heard of CIA operations such as this mounted against foreign governments, called “black operations,” but sometimes more colloquially called “mindf_cking.” (Bernstein and Woodward 1974, pp. 114-115)
Segretti a 'Small Fish in a Big Pond' - An FBI official investigating CREEP’s illegal activities will call Segretti “a small fish in a big pond,” and will say that at least 50 undercover Nixon operatives have worked around the country to disrupt and spy on Democratic campaigns. The political intelligence and sabotage operation is called the “offensive security” program both by White House and CREEP officials. FBI investigators will find that many of the acts of political espionage and sabotage conducted by Segretti and his colleagues are traced to this “offensive security” program, which was conceived and directed in the White House and by senior CREEP officials, and funded by the secret “slush fund” directed by CREEP finance manager Maurice Stans (see September 29, 1972). FBI officials will refuse to directly discuss Segretti’s actions, saying that he is part of the Watergate investigation (see 2:30 a.m.June 17, 1972), but one FBI official angrily calls Segretti’s actions “indescribable.”
White House Connections Confirmed - In mid-October 1972, the Washington Post will identify Dwight Chapin, President Nixon’s appointments secretary, as the person who hired Segretti and received reports of his campaign activities. Segretti’s other contact is Hunt. Segretti also received at least $35,000 in pay for his activities by Nixon’s personal lawyer, Herbert Kalmbach. (Meyer 1/31/1973)
President Nixon authorizes the creation of a “special investigations unit,” later nicknamed the “Plumbers,” to root out and seal media leaks. The first target is Daniel Ellsberg, who leaked the Pentagon Papers to the press (see June 13, 1971); the team will burglarize the office of Ellsberg’s psychiatrist, Dr. Lewis Fielding, in hopes of securing information that the White House can use to smear Ellsberg’s character and undermine his credibility (see September 9, 1971). Nixon aide John Ehrlichman, who supervises the “Plumbers,” will later say that the Ellsberg burglary is “the seminal Watergate episode.” Author Barry Werth will later write, “[L]ike all original sins, it held the complete DNA of subsequent misdeeds.” During the upcoming court battle over the documents, Nixon tells his aide Charles Colson: “We’ve got a countergovernment here and we’ve got to fight it. I don’t give a damn how it’s done. Do whatever has to be done to stop those leaks.… I don’t want to be told why it can’t be done.” Whatever damaging information the “Plumbers” can find on Ellsberg will be itself leaked to the press, Nixon says. “Don’t worry about his trial [referring to Ellsberg’s arrest on conspiracy and espionage charges (see June 28, 1971) ]. Just get everything out. Try him in the press… leak it out.” (Werth 2006, pp. 84-87) As he is wont to do, Nixon refers to his own success in convicting suspected Communist spy Alger Hiss in 1950. “We won the Hiss case in the papers,” he says. “We did. I had to leak stuff all over the place. Because the Justice Department would not prosecute it.… It was won in the papers…. I leaked out the papers. I leaked everything.… I leaked out the testimony. I had Hiss convicted before he ever got to the grand jury.” (Kutler 1997, pp. 10; Reeves 2001, pp. 337-338) In July 1973, FBI deputy director W. Mark Felt, the notorious “Deep Throat” (see May 31, 2005) will tell reporter Bob Woodward that Nixon created the Plumbers because the FBI would not do his bidding in regards to Ellsberg. Had the FBI agreed to investigate Ellsberg to the extent Nixon wanted, he would not have created the “Plumbers.” “The problem was that we [the FBI] wouldn’t burglarize” (see June 30-July 1, 1971), Felt will say. Ehrlichman will later testify, “Those fellows were going out as substitutes for the FBI.” (Woodward 2005, pp. 107)
FBI Director J. Edgar Hoover promotes W. Mark Felt to be the #3 official in the bureau. Though Hoover’s longtime assistant and confidante Clyde Tolson is putatively the #2 man at the bureau, Tolson is seriously ill and does not often come to work, so Felt essentially becomes the FBI’s deputy director, in charge of day-to-day operations. Felt has access to virtually every piece of information the FBI possesses. Felt will become the celebrated “Deep Throat,” Washington Post reporter Bob Woodward’s inside source for the Watergate investigations (see May 31, 2005). (Woodward 2005, pp. 35)
Syndicated columnist Jack Anderson receives a memo written by International Telephone and Telegraph (ITT) lobbyist Dita Beard; the memo goes a long way towards proving that in return for hefty campaign contributions to the GOP, the Justice Department dropped its antitrust suit against the corporation (see 1969 and July 31, 1971). The memo, written on June 25, 1971 by Beard to ITT vice president Bill Merriam, is entitled “Subject: San Diego Convention.” Beard indicated her distress at the possibility of someone leaking the fact that ITT had quietly contributed $400,000 to the GOP for its 1972 convention in San Diego. Two of the few who know of the contribution, Beard wrote, were President Nixon and Attorney General John Mitchell. She asked whether the $400,000 should be donated in cash or in services, then wrote: “I am convinced because of several conversations with Louie re Mitchell that our noble commitment has gone a long way toward our negotiations on the mergers eventually coming out as Hal wanted them. Certainly the president has told Mitchell to see that things are working out fairly. It is still only McLaren’s mickey-mouse that we are suffering.” Anderson doesn’t know who “Louie” is, but he is sure “Hal” is Harold Geneen, ITT’s president. ITT had announced a $100,000 contribution, but the real amount is four times that. One of Anderson’s aides, Brit Hume, interviews Beard, and during a night of heavy drinking and Beard’s emotional outbursts, finds out that in May 1971, Beard had gone to a party hosted by Kentucky governor Louie Nunn, the “Louie” of the memo. Mitchell was at the party, and Beard was there to prime Mitchell as to what exactly ITT wants in return for its contribution and its assurance that it can secure San Diego as the GOP’s convention site. According to Beard, the deal was hatched between herself and Mitchell at Nunn’s party. Anderson quickly publishes a column based on the memo that causes a tremendous stir in Washington and the press. (Anderson 1999, pp. 194-200) (In his book The Secret Man, Bob Woodward will give the date for Anderson’s column revealing the Beard memo as February 19. This is apparently a typographical error.) (Woodward 2005, pp. 37) The White House will successfully pressure Beard to disavow the memo (see Mid-Late March, 1972).
Around 4 p.m, gunman Arthur Bremer shoots Alabama Governor George Wallace in a Maryland shopping center. Wallace, mounting a third-party bid for the presidency, survives the shooting, but is crippled for life. He is also essentially out of the race. The political ramifications are powerful: Wallace, a segregationist Democrat, is doing well in many Southern states. With Wallace out of the picture, his voters will almost uniformly go to Richard Nixon, and whatever threadbare chance of victory Democratic candidate George McGovern has of defeating Nixon is over.
Lone Gunman - There is no evidence to connect Nixon or the GOP with Bremer—all evidence will show that Bremer is a classic “lone gunman” who stalked several presidential candidates before gunning down Wallace—but Nixon and his campaign officials know that even a hint of a connection between the Nixon campaign and Bremer would be politically devastating.
Break-in - On the night of the shooting, Nixon aide Charles Colson orders campaign operative E. Howard Hunt (see 2:30 a.m.June 17, 1972) to break into Bremer’s Milwaukee apartment to discover if Bremer had any political connections (hopefully Democratic or liberal connections, though none are ascertained). (Woodward 2005, pp. 47-50) Interestingly, by 6:30 p.m., White House communications official Ken Clawson calls the Washington Post to announce that “left-wing” literature had been found in Bremer’s apartment, and that Bremer may have been associated with the presidential campaign of George McGovern. No such evidence is found. Colson tells reporters that Bremer is a dues-paying member of the Young Democrats of Milwaukee, a lie that makes it into several newspapers. Post editor Howard Simons will consider the idea that Wallace was assassinated on the orders of the White House—“the ultimate dirty trick”—but no evidence of that connection ever surfaces. (Bernstein and Woodward 1974, pp. 326; Reeves 2001, pp. 480)
FBI Leaves Apartment - Hunt will claim in his autobiography, Undercover, that he refused the order to burglarize Bremer’s apartment. The FBI finds both left-wing and right-wing literature in Bremer’s apartment, as well as a diary whose opening line is, “Now I start my diary of my personal plot to kill by pistol either Richard Nixon or George Wallace.” Local reporters will later claim that the FBI leaves Bremer’s apartment for about 90 minutes, during which time reporters and other unidentified figures are able to spirit away papers and other materials. It is not clear whether Hunt is one of those “unidentified figures.” (Spartacus Schoolnet 8/2007)
Deep Throat - Top FBI official W. Mark Felt provides useful information for Washington Post reporter Bob Woodward’s profile of Bremer, operating as a “deep background” source. It is the first time Felt, who will become Woodward’s “Deep Throat” Watergate source (see May 31, 2005), gives important information to Woodward. (Woodward 2005, pp. 47-50)
The Nixon administration spends $8,400 on fake telegrams and advertisements to create a false impression of public support for the US mining of Vietnam’s Haiphong harbor. This will not come to light until March 1973, when a disaffected official of the Nixon campaign (CREEP) tells Washington Post reporter Bob Woodward of the operation. The false telegrams are sent to the White House and publicly presented by press secretary Ron Ziegler and other Nixon officials. In addition, CREEP purchases an advertisement in the New York Times purporting to be from a group of “concerned citizens” that attacks the Times for its opposition to the mining operation. “The [Times] ad was paid for by CREEP with 40 of those $100 bills in [CREEP finance director Maurice] Stans’s safe,” the official will say (see Before April 7, 1972). Another CREEP official will tell Woodward that the Haiphong public relations offensive “put the entire staff in overdrive for two weeks,” between creating false telegrams, busing supporters to Washington, organizing petition drives and phone campaigns, and getting supporters to call Congress. After the Post prints the story, Woodward learns that CREEP also rigged a poll conducted by Washington television station WTTG. The poll was based on sample ballots printed in the local newspapers. CREEP has ten people working for days purchasing newspapers, filling out ballots in different handwriting, and mailing them in. The fake ballots radically skew the poll in favor of the mining operation. A CREEP spokesman will confirm the ballot-stuffing operation and say, “We assumed the other side would do it also.” Frank Mankiewicz, a senior campaign aide for the presidential campaign of Democratic candidate George McGovern, will respond incredulously: “It didn’t occur to us, believe me. Those guys are something. They assume we have the same sleazy ethics as them.” (Bernstein and Woodward 1974, pp. 265-267; Pike 2008)
Five burglars (see June 17, 1972) are arrested at 2:30 a.m. while breaking in to the Democratic National Committee (DNC) Headquarters offices in Washington’s Watergate hotel and office complex; the DNC occupies the entire sixth floor. (Lewis 6/18/1972; Gerald R. Ford Library and Museum 7/3/2007)
Discovery - They are surprised at gunpoint by three plainclothes officers of the DC Metropolitan Police. Two ceiling panels have been removed from the secretary’s office, which is adjacent to that of DNC chairman Lawrence O’Brien. It is possible to place a surveillance device above those panels that could monitor O’Brien’s office. The five suspects, all wearing surgical gloves, have among them two sophisticated voice-activated surveillance devices that can monitor conversations and telephone calls alike; lock-picks, door jimmies, and an assortment of burglary tools; and $2,300 in cash, most of it in $100 bills in sequence. They also have a walkie-talkie, a shortwave receiver tuned to the police band, 40 rolls of unexposed film, two 35mm cameras, and three pen-sized tear gas guns. Near to where the men are captured is a file cabinet with two open drawers; a DNC source speculates that the men might have been preparing to photograph the contents of the file drawers.
Guard Noticed Taped Door - The arrests take place after a Watergate security guard, Frank Wills, notices a door connecting a stairwell with the hotel’s basement garage has been taped so it will not lock; the guard removes the tape, but when he checks ten minutes later and finds the lock taped once again, the guard calls the police. The police find that all of the stairwell doors leading from the basement to the sixth floor have been similarly taped to prevent them from locking. The door leading from the stairwell to the DNC offices had been jimmied. During a search of the offices, one of the burglars leaps from behind a desk and surrenders. (Lewis 6/18/1972) The FBI agents responding to the burglary are initially told that the burglars may have been attempting to plant a bomb in the offices. The “bomb” turns out to be surveillance equipment. (O.T. Jacobson 7/5/1974 )
Last Mission for Martinez - One of the burglars, Cuban emigre and CIA agent Eugenio Martinez, will recall the burglary. They have already successfully burglarized a psychiatrist’s office in search of incriminating material on Pentagon Papers leaker Daniel Ellsberg (see September 9, 1971), and successfully bugged the DNC offices less than a month previously (see May 27-28, 1972), but Martinez is increasingly ill at ease over the poor planning and amateurish behavior of his colleagues (see Mid-June 1972). This will be his last operation, he has decided. Team leader E. Howard Hunt, whom Martinez calls by his old code name “Eduardo,” is obviously intrigued by the material secured from the previous burglary, and wants to go through the offices a second time to find more. Martinez is dismayed to find that Hunt has two operations planned for the evening, one for the DNC and one for the campaign offices of Democratic candidate George McGovern. Former CIA agent and current Nixon campaign security official James McCord (see June 19, 1972), the electronics expert of the team, is equally uncomfortable with the rushed, almost impromptu plan. Hunt takes all of the burglars’ identification and puts it in a briefcase. He gives another burglar, Frank Sturgis, his phony “Edward J. Hamilton” ID from his CIA days, and gives each burglar $200 in cash to bribe their way out of trouble. Interestingly, Hunt tells the burglars to keep the keys to their hotel rooms. Martinez later writes: “I don’t know why. Even today, I don’t know. Remember, I was told in advance not to ask about those things.”
Taping the Doors - McCord goes into the Watergage office complex, signs in, and begins taping the doors to the stairwells from the eighth floor all the way to the garage. After waiting for everyone to leave the offices, the team prepares to enter. Gonzalez and Sturgis note that the tape to the basement garage has been removed. Martinez believes the operation will be aborted, but McCord disagrees; he convinces Hunt and the other team leader, White House aide G. Gordon Liddy, to continue. It is McCord’s responsibility to remove the tape once the burglars are inside, but he fails to do so. The team is well into the DNC offices when the police burst in. “There was no way out,” Martinez will recall. “We were caught.” Barker is able to surreptitiously advise Hunt, who is still in the hotel, that they have been discovered. Martinez will later wonder if the entire second burglary might have been “a set-up or something like that because it was so easy the first time. We all had that feeling.” The police quickly find the burglars’ hotel keys and then the briefcase containing their identification. As they are being arrested, McCord, who rarely speaks and then not above a whisper, takes charge of the situation. He orders everyone to keep their mouths shut. “Don’t give your names,” he warns. “Nothing. I know people. Don’t worry, someone will come and everything will be all right. This thing will be solved.” (Martinez and Barker 10/1974; Spartacus Schoolnet 8/7/2007)
'Third-Rate Burglary' - White House press secretary Ron Ziegler will respond to allegations that the White House and the Nixon presidential campaign might have been involved in the Watergate burglary by calling it a “third-rate burglary attempt,” and warning that “certain elements may try to stretch this beyond what it is.” (Stern and Johnson 5/1/1973) The Washington Post chooses, for the moment, to cover it as a local burglary and nothing more; managing editor Howard Simons says that it could be nothing more than a crime committed by “crazy Cubans.” (Bernstein and Woodward 1974, pp. 19)
CIA Operation? - In the weeks and months to come, speculation will arise as to the role of the CIA in the burglary. The Nixon White House will attempt to pin the blame for the Watergate conspiracy on the CIA, an attempt forestalled by McCord (see March 19-23, 1973). In a 1974 book on his involvement in the conspiracy, McCord will write: “The Watergate operation was not a CIA operation. The Cubans may have been misled by others into believing that it was a CIA operation. I know for a fact that it was not.” Another author, Carl Oglesby, will claim otherwise, saying that the burglary is a CIA plot against Nixon. Former CIA officer Miles Copeland will claim that McCord led the burglars into a trap. Journalist Andrew St. George will claim that CIA Director Richard Helms knew of the break-in before it occurred, a viewpoint supported by Martha Mitchell, the wife of Nixon campaign director John Mitchell, who will tell St. George that McCord is a “double agent” whose deliberate blunders led to the arrest of the burglars. No solid evidence of CIA involvement in the Watergate conspiracy has so far been revealed. (Spartacus Schoolnet 8/2007)
Washington Post reporter Bob Woodward learns that two of the Watergate burglars (see 2:30 a.m.June 17, 1972) have the name “E. Howard Hunt” in their address books, both with notations that indicate Hunt has a post at the White House. Woodward contacts his FBI source, W. Mark Felt—later known as “Deep Throat” (see May 31, 2005)—and asks Felt the first of many Watergate-related questions. Felt is reticent, merely telling Woodward that the burglary will “heat up” before hanging up on Woodward. Unsure what to do next, Woodward calls the White House and asks for Hunt. When no one answers Hunt’s office phone, the White House operator suggests that Hunt may be in the office of Charles Colson, the special counsel to President Nixon. Colson’s office gives Woodward the number of the Mullen Company, a public relations firm for which Hunt writes (Mullen is a possible CIA front company—see June 17, 1972). Woodward calls Hunt there, and when Hunt answers, asks him why his name is in the address book of two of the Watergate burglars. “Good God!” Hunt shouts, then says he has no comment, and slams down the phone. Within hours, Hunt will go into hiding. White House communications official Ken Clawson tells Woodward that Hunt worked with the White House in declassifying the Pentagon Papers (see March 1971), and, more recently, on a narcotics enforcement project. Clawson then puzzles Woodward by making the following unsolicited statement: “I’ve looked into the matter very thoroughly, and I am convinced that neither Mr. Colson nor anyone else at the White House had any knowledge of, or participation in, this deplorable incident at the Democratic National Committee.” Woodward soon learns that Hunt was a CIA agent between 1949 and 1970. Woodward again calls Felt, who guardedly tells him that Hunt is connected to the burglaries by far more than mere address books. Felt does not tell Woodward that he has already reviewed Hunt’s White House personnel file, and found that Hunt worked over 600 hours for Colson in less than a year. (Bernstein and Woodward 1974, pp. 24-25; Woodward 2005, pp. 56-58)
James McCord, one of the five Watergate burglars (see June 17, 1972), is identified as the security director for the Committee to Re-elect the President (CREEP). McCord is also identified as a security consultant for the Republican National Committee (RNC), where he has maintained an office since January 1. After his arrest, McCord used a phony name to the police and the court, which kept his identity unclear for two days. The director of CREEP, former attorney general John Mitchell, originally denies that McCord is a member of the campaign, and merely identifies him as a Republican security aide who helped CREEP install a security system. (McCord has his own security business in Maryland, McCord Associates (see June 18, 1972).) (Woodward and Bernstein 6/19/1972; Gerald R. Ford Library and Museum 7/3/2007) Washington Post reporter Bob Woodward learns that McCord is a member of a small Air Force Reserve unit in Washington attached to the Office of Emergency Preparedness (OEP); the OEP, says a fellow reservist, is tasked with compiling lists of “radicals” and developing contingency plans for censorship of the news media and the US mail in time of war. (Bernstein and Woodward 1974, pp. 23) RNC chairman Bob Dole says that McCord provided similar services for that organization, and says of the burglary, “we deplore action of this kind in or out of politics.” Democratic Party chairman Lawrence O’Brien, whose offices were burgled and subject to electronic surveillance, says the “bugging incident… raised the ugliest questions about the integrity of the political process that I have encountered in a quarter century,” and adds, “No mere statement of innocence by Mr. Nixon’s campaign manager will dispel these questions.” (O’Brien has inside knowledge of the White House connections (see June 17, 1972).) O’Brien calls on Mitchell’s successor, Attorney General Richard Kleindienst, to order an immediate, “searching professional investigation” of the entire matter by the FBI. The FBI is already mounting an investigation. (Woodward and Bernstein 6/19/1972; Gerald R. Ford Library and Museum 7/3/2007)
President Nixon tells a gathering of reporters regarding the Watergate burglary (see 2:30 a.m.June 17, 1972), “The White House has no involvement in this particular incident.” Washington Post reporters Carl Bernstein and Bob Woodward find the phrasing—“this particular incident”—interesting. They have already unearthed numerous connections between the White House and the Watergate burglars, some more tenuous than others, but all pointing to a larger, if indistinct, pattern:

A Miami architect says that burglar Bernard Barker tried to obtain blueprints of the Miami convention hall and its air-conditioning system.
Burglar E. Howard Hunt’s boss at the public relations firm he works for (see June 17, 1972), Robert Bennett, has organized over 100 dummy campaign committees that have been used to funnel millions of dollars into the Nixon re-election campaign.
Burglar James McCord (see 2:30 a.m.June 17, 1972) was carrying an application for college press credentials for the Democratic convention when he was arrested.
Three of the Watergate burglars, all Miami residents, had been in Washington at the same time the offices of some prominent Democratic lawyers in the Watergate had been burgled. (Bernstein and Woodward 1974, pp. 29)
Martha Mitchell, the wife of Nixon campaign director John Mitchell, makes an unexpected phone call to UPI reporter Helen Thomas. Mrs. Mitchell is initially calm and even a bit sad, but when Thomas brings up the subject of Watergate, Mrs. Mitchell becomes agitated. She is “sick of the whole business,” she says, and adds: “I’ve given John an ultimatum. I’m going to leave him unless he gets out of the campaign. I’m sick and tired of politics. Politics is a dirty business.” (Thomas 1999, pp. 210-211) Suddenly she screams, “You just get away—get away!” and the line goes dead. (Reeves 2001, pp. 508) Three days later she calls Thomas again and asserts that she is a political prisoner in her own home. “I’m not going to stand for all of those dirty things that go on,” she shouts. “If you could see me, you wouldn’t believe it. I’m black and blue.” Washington Post reporter Bob Woodward believes that Mrs. Mitchell might be an unexpected fount of information about her husband’s inner dealings in the Watergate conspiracy, but when he interviews her in September, she will reveal nothing of import. (Bernstein and Woodward 1974, pp. 92-95) In October 1972, W. Mark Felt, Washington Post reporter Bob Woodward’s FBI background source (see May 31, 2005), says of Mrs. Mitchell, “She knows nothing, apparently, but that doesn’t mean she won’t talk.” (Bernstein and Woodward 1974, pp. 133)
FBI Director L. Patrick Gray meets with White House aides John Ehrlichman and John Dean in Ehrlichman’s White House office. Dean gives Gray two files that he says came from Watergate burglar E. Howard Hunt’s office safe (see June 22-26, 1972). Gray should keep the files, Dean says; they are “political dynamite” that “should never see the light of day.” Gray will later burn the files rather than turn them over to the FBI (see April 27-30, 1973). (O.T. Jacobson 7/5/1974 ) According to Dean’s later testimony to the Senate Watergate Committee (see June 25-29, 1973), among the contents is a briefcase containing “loose wires, Chap Sticks with wires coming out of them, and instruction sheets for walkie-talkies.” (Time 7/9/1973) According to Washington Post reporter Bob Woodward’s FBI source W. Mark Felt, Ehrlichman tells Dean, “You go across the [Potomac] river every day, John. Why don’t you drop the g_ddamn f_cking things in the river?” (Bernstein and Woodward 1974, pp. 305-306) Dean tells Ehrlichman “in a joking manner that I would bring the materials over to him and he could take care of them because he also crossed the river on his way home. He said no thank you.” It was after that discussion that the decision was made to give the evidence to Gray. (Time 7/9/1973) Gray keeps the files for about a week, then puts them in an FBI “burn bag.” A Dean associate later tells Post reporter Carl Bernstein, “You ever heard the expression ‘deep six’? That’s what Ehrlichman said he wanted done with those files.” (Bernstein and Woodward 1974, pp. 305-306)
Washington Post reporters Carl Bernstein and Bob Woodward have little luck talking to anyone who works for the Committee to Re-elect the President (CREEP). Both reporters spend several evenings visiting and telephoning CREEP employees at their homes. The first person Bernstein speaks to turns him away, shuddering. He has to leave “before they see you,” she says. “Please leave me alone. I know you’re only trying to do your job, but you don’t realize the pressure we’re under.” Another bursts into tears as she turns him away. “I want to help,” she says, but “God, it’s all so awful.” A third begs: “Please don’t call me on the telephone—God, especially not at work, but not here either. Nobody knows what they’ll do. They are desperate.”
Sally Harmony - One thing they do find out is the level of knowledge possessed by Sally Harmony, G. Gordon Liddy’s secretary at CREEP. Harmony had not been truthful or forthcoming in her recent testimony before the FBI and the grand jury investigating the Watergate break-in (see 2:30 a.m.June 17, 1972). This ties in with another Post reporter’s tip to Bernstein that Harmony lied to protect both her boss and CREEP deputy director Jeb Magruder. A Justice Department attorney confirms the fact that prosecutors believe Harmony was not truthful in her testimony, but they lack the evidence to charge her with perjury.
Destruction of Records - Some CREEP employees guardedly tell Bernstein and Woodward about large-scale destruction of records in the days after the Watergate burglary, but they know no specifics. Those who would know were interviewed by FBI investigators, but were interviewed at CREEP headquarters, in the presence of either a CREEP lawyer or Robert Mardian, the political coordinator of the committee and a former assistant attorney general. According to the employees Bernstein and Woodward interview, Mardian never directly told anyone to lie, but told them not to volunteer anything and evade whenever possible.
Pieces of Information - They garner other shreds of information:
John Mitchell, who resigned from the directorship of CREEP (see July 1, 1972), is still heavily involved in the organization, appearing three times a week “telling Fred LaRue and Bob Mardian what to do.”
Magruder himself is terrified, acting “like the roof is going to fall down on him tomorrow.”
CREEP director Clark MacGregor wanted to write a report detailing his knowledge of campaign finance irregularities, “but the White House said no.”
Prosecutors had asked employees if they knew of other surveillance operations besides the one at Democratic headquarters.
FBI officials had asked about documents being shredded.
“I heard from somebody in finance that if they [the FBI] ever got a look at the books it would be all over, so they burned ‘em.”
Liddy “would never talk” and Harmony talked about her “bad memory.”
“From what I hear they were spying on everybody, following them around, the whole bit.”
The obvious terror of the people they interview unsettles the two reporters. (Bernstein and Woodward 1974, pp. 58-61)
Washington Post reporter Bob Woodward visits his FBI source, top bureau official W. Mark Felt (see May 31, 2005), at Felt’s suburban Virginia home. Felt instructs Woodward that if he is to continue funneling information to Woodward as his “deep background” source, ground rules need to be set. Felt brings his early FBI experience as a Nazi tracker to bear. No more phone calls and no more visits, Felt says. Woodward needs an unobtrusive way to contact Felt to arrange a meeting; Felt suggests that Woodward use a flowerpot with a small red flag currently on his apartment balcony. Moving the flowerpot from the front of the balcony to the rear will alert Felt that Woodward wants a meeting. The meetings will take place at 2 a.m. on the bottom level of an underground parking garage in Rosslyn, Virginia. Woodward is to employ countersurveillance techniques for these meetings—taking the stairs instead of the elevators, taking taxicabs instead of his personal car, switching cabs, walking the last few blocks to the garage. If Felt wants a meeting, he will, by methods he never explains, indicate this by marking Woodward’s morning copy of the New York Times. Woodward is never to divulge anything of Felt’s contacts or their relationship to anyone, Felt insists. “I had never heard of such extreme precautions,” Woodward recalls in 2005. “It was extraordinary.” Woodward realizes that Felt is an extraordinary source taking extraordinary risks, and agrees to the procedures. (Woodward 2005, pp. 61-66)
The Washington Post reports that a $25,000 cashier’s check, apparently earmarked for the campaign to re-elect President Nixon, found its way into the Miami bank account of one of the Watergate burglars, Bernard Barker (see 2:30 a.m.June 17, 1972). (Gerald R. Ford Library and Museum 7/3/2007)
Origin of Check - The check, drawn on a Boca Raton, Florida bank, was made out to Kenneth H. Dahlberg, the finance manager for the Committee to Re-elect the President (CREEP). Dahlberg says that in early April, he gave the check to “the treasurer of the Committee [Hugh Sloan, who has since quit the committee and is cooperating with the FBI investigation] or to Maurice Stans himself.” Stans, formerly Nixon’s secretary of commerce, is CREEP’s finance chief. The money is made up of “[c]ontributions I collected in my role as Midwest finance chairman,” Dahlberg explains. “In the process of fund-raising I had accumulated some cash… so I recall making a cash deposit while I was in Florida and getting a cashier’s check made out to myself. I didn’t want to carry all that cash into Washington.”
Watergate Connections - Barker withdrew much of the money from the same Boca Raton bank account, in $100 bills. 53 of those bills were found on the five Watergate burglars after their arrest. Clark MacGregor, who replaced former Attorney General John Mitchell as the head of CREEP (see July 1, 1972), says he knows nothing about the check or the money found on Barker and the other burglars: “[T]hese events took place before I came aboard. Mitchell and Stans would presumably know.” The Post also learns that another $89,000 in four separate checks were deposited in Barker’s Miami bank account in May (see June 23, 1972). The checks were originally made out to Mexican lawyer Manuel Ogarrio Daguerre, on an account at Mexico’s Banco Internacional. While looking over the story before publication, Post editor Barry Sussman says: “We’ve never had a story like this. Just never.” (Bernstein and Woodward 8/1/1972; Bernstein and Woodward 1974, pp. 43-44)
GAO Will Investigate Nixon Campaign Finances - Stans’s secretary says her boss cannot comment on the story because he is “agoniz[ing] over the confusing circumstances” and does not want to say anything that might compromise his integrity. Philip S. Hughes, the director of the Federal Elections Division of the General Accounting Office (GAO, the investigative arm of Congress), says that the story reveals “for the first time [that] the bugging incident was related to the campaign finance law.… There’s nothing in Maury [Stans]‘s reports showing anything like that Dahlberg check.” Hughes says his office intends to fully audit the Nixon campaign finances. (Bernstein and Woodward 1974, pp. 45-47)
Nixon campaign finance manager Kenneth H. Dahlberg, the subject of a Washington Post article that shows he handled a check that was found in the account of a Watergate burglar (see August 1-2, 1972), confirms to Post reporter Bob Woodward that he gave the check to Nixon campaign finance chief Maurice Stans on April 11. Dahlberg says he knows nothing about any improprieties. “Obviously I’m caught in the middle of something,” Dahlberg says. “What it is I don’t know.” (Bernstein and Woodward 1974, pp. 45-47)
Clark MacGregor, the new head of the Committee to Re-elect the President (CREEP), meets with a select group of White House reporters. In the press conference, MacGregor tries to pin the entire blame for the Watergate conspiracy—burglary and financial shenanigans alike—on burglar and CREEP lawyer G. Gordon Liddy. (Inside sources had predicted MacGregor would do just that (see August 1-2, 1972).) Liddy, MacGregor says, had spent campaign money on his own initiative “for the purpose of determining what to do if the crazies made an attack on the president” at the upcoming Republican National Convention. After the conference, Washington Post reporter Bob Woodward tries to elicit more information from an obviously exasperated MacGregor. MacGregor shouts: “I have no idea why the departed Gordon Liddy wanted cash.… It’s impossible for me to tell. I never met Liddy. I don’t know what’s going on.” (Bernstein and Woodward 1974, pp. 47)
The General Accounting Office (GAO) completes its preliminary report on financial irregularities inside the Nixon re-election campaign (see August 1-2, 1972). According to the report, the campaign has mishandled over $500,000 in campaign contributions, including an apparently illegal “slush fund” of over $100,000—perhaps more than $350,000. The report lists 11 “apparent and possible violations” of the new campaign finance law (see Before April 7, 1972), and refers the matter to the Justice Department for possible prosecution. The GAO agrees to delay its public issuance of its report after the committee’s finance chairman, Maurice Stans, asks GAO chief investigator Philip Hughes to come to Miami, where the Republican National Convention is in full swing, to receive more information. Another GAO investigator tells Washington Post reporter Bob Woodward that the Nixon campaign does not want the report to be made public on the same day that Richard Nixon accepts the Republican nomination for president. (Bernstein and Woodward 1974, pp. 48-56)
US District Court Judge Charles Richey, presiding over the Democratic Party’s lawsuit against the Committee to Re-elect the President (see June 20, 1972), reverses his own ruling and orders all pre-trial statements and depositions to remain sealed until after the lawsuit has run its course. This ensures that court statements by Nixon campaign officials such as John Mitchell, Maurice Stans, and others will not be made public until after the November election. Richey makes the decision unilaterally; no motion for such a decision has been made by campaign lawyers. Richey explains his extraordinary decision by saying he is concerned for the constitutional rights of those involved in the lawsuit. After issuing the ruling, Richey himself calls Washington Post reporter Carl Bernstein to explain his decision. He tells Bernstein, “I want it to be very clear that I haven’t discussed this case outside the courtroom with anyone, and that political considerations played no part whatsoever.” Bernstein is astounded at the call; he has never met Richey, and had not contacted Richey for comment. (Bernstein and Woodward 1974, pp. 49) In November 1972, sources tell Post reporters Bernstein and Bob Woodward that “someone from the government got to Richey through the back door and got him to help the administration; a Republican governor said he could get to Richey and word came back that there was no need, it had already been done.” In their subsequent testimony, White House aides John Dean and H. R. Haldeman and Nixon campaign chairman John Mitchell all confirm that Richey was approached by Roemer McPhee, a close friend of Mitchell’s who, Dean will testify, pressured Richey into siding with the administration in the lawsuit. Richey will deny that McPhee tried to influence him. (Bernstein and Woodward 1974, pp. 206)
In a Washington Post story about a press conference held by President Nixon (see August 29, 1972), reporters Carl Bernstein and Bob Woodward report a conversation with Enrique Valledor, president of the Florida Association of Realtors and the former boss of Watergate burglar Bernard Barker (see 2:30 a.m.June 17, 1972). Valledor recalls asking about Barker’s potential liability in the million-dollar lawsuit filed by the Democrats over the Watergate break-in (see June 20, 1972). Barker replies: “I’m not worried. They’re paying for my attorneys.” Valledor asks, “Who are they?” and Barker responds, “I can’t tell you.” It is the first public hint of direct monetary payments to the burglars by either White House or Nixon campaign officials. (Bernstein and Woodward 1974, pp. 57-58)
President Nixon responds to the report by the General Accounting Office (GAO) alleging possible illegal campaign finances in his re-election campaign (see August 22, 1972). Nixon tells reporters, “[W]e have a new law here in which technical violations have occurred and are occurring, apparently on both sides.” When asked what illegalities the Democrats have committed, Nixon says: “I think that will come out in the balance of this week. I will let the political people talk about, but I understand that there have been [violations] on both sides.” The financial director of his re-election campaign, Maurice Stans (see Before April 7, 1972), is an honest man, Nixon says, and is currently investigating the matter “very, very thoroughly, because he doesn’t want any evidence at all to be outstanding, indicating that we have not complied with the law.” Between the GAO’s and the FBI’s investigations, Stans’s own internal investigation, and an internal White House investigation by White House counsel John Dean, Nixon says there is no need for a special Watergate prosecutor, as some have requested. Of the Dean investigation: “I can say categorically that his investigation indicates that no one on the White House staff, no one in this administration, presently employed, was involved in this very bizarre incident [the Watergate burglary—see 2:30 a.m.June 17, 1972]. What really hurts in matters of this sort is not the fact that they occur, because overzealous people in campaigns do things that are wrong. What really hurts is if you try to cover it up.” (Bernstein and Woodward 1974, pp. 57; Gerald R. Ford Library and Museum 7/3/2007) A Washington Post story on the press conference highlights Nixon’s use of the phrase “presently employed,” and notes that several people suspected of campaign wrongdoing—G. Gordon Liddy, E. Howard Hunt, Maurice Stans, Hugh Sloan, and John Mitchell—no longer work for the administration. (Bernstein and Woodward 1974, pp. 57) An assistant attorney general is convinced that the Dean investigation is “a fraud, a pipeline to [White House aide H. R.] Haldeman.” (Bernstein and Woodward 1974, pp. 206) In April 1973, an associate of Dean tells Washington Post reporter Bob Woodward that there was never any such investigation, that Dean had not even discussed anything to do with Watergate as of August 29. “There never was a report,” the associate says. “Dean was asked to gather certain facts. The facts got twisted around to help some other people above him.” (Bernstein and Woodward 1974, pp. 297-298) Dean later tells Watergate investigators that he never conducted any such internal White House investigation (see June 3, 1973). (Bernstein and Woodward 6/3/1973)
Washington Post reporters Bob Woodward and Carl Bernstein are discussing their upcoming story documenting the secret Nixon campaign “slush fund” controlled by former Attorney General John Mitchell (see Early 1970 and September 29, 1972) when Bernstein has an epiphany of sorts—a “literal chill going down my neck,” he will recall in 2005. “Oh my God,” he tells Woodward. “The president is going to be impeached.” After a moment, Woodward replies, “Jesus, I think you’re right.” Woodward then says, “We can never use that word in this newsroom.” No one in Congress has broached the subject of impeachment yet, and will not for another year, but neither journalist wants anyone to think that they might have some sort of agenda in their reporting. “Any suggestion about the future of the Nixon presidency could undermine our work and the Post’s efforts to be fair,” Bernstein will later write. The two will later decide not to include this anecdote in their book All the President’s Men (see June 15, 1974), as it would be published during the House Judiciary Committee’s impeachment investigation of President Nixon (see February 6, 1974). “To recount it then might have given the impression that impeachment had been our goal all along,” Bernstein will write. “It was not. It was always about the story.” (Woodward 2005, pp. 229-230)
Washington Post reporter Carl Bernstein manages to land a meeting with a low-level employee of the Committee to Re-elect the President (CREEP); like the other employees he and his colleague Bob Woodward have interviewed, she is frightened (see August, 1972), but more willing to speak out.
Meeting - The employee insists that they meet for lunch in a public restaurant frequented by CREEP personnel, so that she will not seem as if she is meeting clandestinely with a reporter. Bernstein asks if she is not being overdramatic, and she responds: “I wish I was. They know everything at the committee. They know that the indictments (see September 15, 1972) will be down in a week and that there will be only seven. Once, another person went back to the [district attorney] because the FBI didn’t ask her the right questions. That night her boss knew about it. I always had one institution I believed in—the FBI. No more.”
Does Not Think Story Will Come Out - She also went back to the DA, she says, but has no faith that the story will ever come to light. “It’ll never come out, the whole truth. You’ll never get the truth. You can’t get it by reporters just talking to the good people. They know you’ve been out talking to people at night. Somebody from the press office came up to our office today and said, ‘I sure wish I knew who in this committee had a link to Carl Bernstein and Bob Woodward.’ The FBI never even asked me if I was at the committee over the weekend of the break-in. I was there almost the whole time. [Robert] Odle [CREEP’s personnel director] didn’t tell them everything he knew. He kept removing records. I don’t know if he destroyed them or not. He would tell everybody to get out of the room and then close the door. Then he’d leave with the records.… The whole thing is being very well covered up and nobody will ever know what happened.”
Names Named - As Bernstein walks her back to her office—again, to avoid the appearance of trying to hide her contact with the press—she adds: “Okay, I’ll tell you, but it won’t do any good. And don’t ever call me, or come to see me or ask any questions about how I know. LaRue, Porter, and Magruder. They all knew about the bugging, or at least lied to the grand jury about what they know. And Mitchell. But Mitchell is mostly speculation. Take my word on the other three. I know.” Frederick LaRue, Bart Porter, Jeb Magruder, and John Mitchell are all former White House officials who moved over to work for CREEP.
Discovered - Later that afternoon, Bernstein receives a phone call from the woman, who is near hysteria. “I’m in a phone booth,” she says. “When I got back from lunch, I got called into somebody’s office and confronted with the fact that I had been seen talking to a Post reporter. They wanted to know everything. It was high up; that’s all you have to know. I told you they were following me. Please don’t call me again or some to see me.” That evening, Bernstein and Woodward go to her apartment; she refuses to open the door. Shortly thereafter, CREEP director Clark MacGregor calls Post executive editor Ben Bradlee to complain that Bernstein and Woodward have been harassing his employees. (Bernstein and Woodward 1974, pp. 60-62)
Washington Post reporter Carl Bernstein interviews a reluctant source, a bookkeeper for the Committee to Re-elect the President (CREEP). In All the President’s Men (see June 15, 1974), Bernstein and co-author Bob Woodward merely identify her as “The Bookkeeper” (Bernstein and Woodward 1974, pp. 63-68) , but she will later be identified as Judy Hoback. Hoback tries to persuade Bernstein to leave her apartment, but Hoback’s sister, who is also present, seems supportive of Bernstein, and the reporter tries to find ways to stay and winkle information out of Hoback. But Hoback seems willing to play along with Bernstein to an extent. She will not provide damaging information against her boss, Maurice Stans, but otherwise she says she wants the truth to come out. She says the top officials at CREEP have decided to try to pin the blame for everything on former CREEP treasurer Hugh Sloan, for whom she feels great sympathy. She confirms that documents have been destroyed to prevent investigators from finding the truth behind the financial improprieties, and confirms the existence of a secret campaign “slush fund,” saying that CREEP deputy director Jeb Magruder was one official in charge of managing the fund. In a subsequent interview conducted by both reporters, Hoback confirms that G. Gordon Liddy received cash from the fund, as well as CREEP scheduling director Bart Porter. She confirms that several CREEP officials, including personnel director Robert Odle, lied to the investigating grand jury. Like so many other CREEP employees, Hoback has no faith that the FBI is conducting any sort of impartial investigation: “My feeling is that the FBI turns the information in and it goes upstairs,” presumably to the White House. Although Hoback’s information is more tantalizing than useful at the moment, Bernstein and Woodward will use her statements as confirmation for other, subsequent allegations. (Bernstein and Woodward 1974; Woodward 2005, pp. 228)
Disappointed that the Watergate burglary indictments do not extend further than the five burglars and their two handlers (see 2:30 a.m.June 17, 1972 and September 15, 1972), Washington Post reporter Bob Woodward contacts W. Mark Felt (“Deep Throat”—see May 31, 2005), his FBI source, to ask about a story he and fellow reporter Carl Bernstein have drafted about the indictment. Woodward breaks the rules Felt laid down for contacting him (see August 1972), but Felt does not complain. Instead, Felt tells Woodward that the story is “[t]oo soft.” “You can go much stronger,” he says. Felt tells Woodward to look into “other intelligence gathering activities” beyond Watergate. Felt says that the money for the burglary and other operations is controlled by top assistants to former Attorney General John Mitchell, now chief of the Nixon re-election campaign (CREEP). In a frantic set of meetings with Judy Hoback, the treasurer of CREEP, Bernstein learns of a secret campaign fund managed by two top campaign aides, Jeb Magruder and Herbert L. “Bart” Porter, as well as White House aide and Watergate figure G. Gordon Liddy. Woodward calls Felt for more details, and after Felt abjures Woodward to make this his last phone call, confirms Magruder and Porter’s involvement. In essence, Felt tells Woodward to “follow the money,” though Woodward will not recall Felt using those exact words. (Bernstein and Woodward 1974, pp. 73; Woodward 2005, pp. 69-71)
Washington Post reporter Bob Woodward lands a telephone interview with the deputy director of the Nixon re-election campaign, Jeb Magruder. Magruder figures heavily in the illegal finances of the campaign (see September 14-17, 1972), and wants to clear his name. He says that the FBI determined that reports of his receiving $50,000 or more from the CREEP “slush fund” are incorrect. Woodward refuses to back off on an upcoming story detailing Magruder’s involvement in the campaign fund, but agrees to say that “government investigators,” and not the FBI specifically, had informed Magruder of the allegations against him. The interview has little of substance, but Woodward notes Magruder’s tone: though he is the second most powerful official at CREEP, his voice shakes while talking to the reporter. (Bernstein and Woodward 1974, pp. 77-78)
The former treasurer for the Campaign to Re-elect the President (CREEP), Hugh Sloan, tells Washington Post reporter Carl Bernstein that the situation with CREEP’s finances is far worse than the Post has reported (see September 14-17, 1972). “That’s why I left, because I suspected the worst,” he says. He refuses to give specifics, citing the continuing FBI investigation and his lawyer’s advice to remain silent. He does confirm that CREEP officials had instructed employees to be evasive when interviewed by the FBI (see August, 1972), and that the committee’s handling of the FBI investigation was managed by CREEP officials Robert Mardian and Frederick LaRue. He also confirms that former CREEP director John Mitchell knew of the illegal campaign “slush fund” (see September 29, 1972). “Mitchell had to know of the funds,” Sloan says. “You don’t just give out that kind of money without the head of the campaign knowing what it’s going for, especially when his people are getting the cash.” Mitchell, LaRue, and Mardian are the three directly responsible for managing the fund, Sloan believes, and are responsible for ordering the destruction of financial records after the Watergate burglary (see 2:30 a.m.June 17, 1972). The previously reported “convention security” fund (see July 7, 1972) and the campaign “slush fund” are one and the same, Sloan confirms. Sloan acknowledges making payouts from the fund, but will not reveal who authorized him to do so. Perhaps most interestingly, Sloan says that the general perception of the Nixon administration and CREEP as two separate, self-contained entities is wrong, that everything CREEP does is managed by senior White House officials. Coming away from the meeting, Bernstein and his colleague Bob Woodward are now sure that the Watergate conspiracy does not end in CREEP, but extends into the White House itself. (Bernstein and Woodward 1974, pp. 79-86)
The Washington Post reports that John Mitchell, the former attorney general and former head of the Committee to Re-elect the President (CREEP), personally controlled a secret Republican “slush fund” used to finance widespread intelligence-gathering operations against the Democratic Party (see Early 1970). (Gerald R. Ford Library and Museum 7/3/2007) Mitchell had authorized expenditures from the fund beginning in the spring of 1971, while he was attorney general. (Bernstein and Woodward 1974, pp. 98-103) The fund was originally conceived by White House aide G. Gordon Liddy, who in 1972 came up with what he called “Operation Gemstone,” a $1 million plan to carry out a series of covert and often illegal actions against President Nixon’s political enemies (see January 29, 1972). Mitchell scaled back the budget to $250,000 (at first) to launch a scaled-down version of Gemstone. (Spartacus Schoolnet 8/2007) Mitchell personally approved a number of withdrawals from the fund, which swelled in size from around $350,000 to $700,000 at any given time. Four others besides Mitchell were later authorized to approve payments from the secret fund. One is Maurice Stans, the former commerce secretary who is now finance chairman of CREEP; the fund was kept in a safe in Stans’s office. A second is Jeb Magruder, the former manager of CREEP who is now deputy director of the organization. A third is a senior White House official involved in the campaign, and the other is a campaign aide based outside of Washington. (Bernstein and Woodward 9/29/1972) (Washington Post reporters Carl Bernstein and Bob Woodward are all but convinced that the “senior White House official” is H. R. Haldeman, but they cannot get anyone to go on record to confirm their assumption, and therefore do not print Haldeman’s name in the story.) (Bernstein and Woodward 1974, pp. 100)
Mitchell's Explosive Reaction - Mitchell is outraged by the allegations. When Bernstein calls to confirm the story, he explodes: “Jesus!… All that crap, you’re putting it in the paper? It’s all been denied. Katie Graham [Katherine Graham, publisher of the Post] is gonna get caught in a big fat wringer if that’s published. Good Christ! That’s the most sickening thing I’ve ever heard.” (The actual quote, which Post executive editor Ben Bradlee cleans up for public consumption, is, “Katie Graham’s gonna get her t_t caught in a big fat wringer if that’s published.”) (Bernstein and Woodward 9/29/1972; Bernstein and Woodward 1974, pp. 105; Woodward 2005, pp. 72) Mitchell continues: “You fellows got a great ball game going. As soon as you’re through paying Williams [Edward Bennett Williams, whose law firm represents the Democratic Party, as well as the Post], we’re going to do a story on all of you.” When Bradlee hears of Mitchell’s reaction, he asks if Mitchell was drunk. When Bernstein replies that he doesn’t believe so, and Bradlee confirms that Bernstein properly identified himself as a reporter, Bradlee tells Bernstein to print Mitchell’s reaction. CREEP spokesman Powell Moore tries to persuade Bradlee not to run the Mitchell quote, saying that it wasn’t fair to run the quote because Bernstein woke Mitchell up, and therefore Mitchell’s “composure [was] not guarded.” Bradlee refuses to delete the quote. (Bernstein and Woodward 9/29/1972; Bernstein and Woodward 1974, pp. 105-108)
CREEP Denials - Moore later states that neither Mitchell or Stans knows anything about “any disbursement from an alleged fund as described by the Post and neither of them controlled any committee expenditures while serving as government officials.” One of the planners of the Watergate burglary (see 2:30 a.m.June 17, 1972), G. Gordon Liddy, withdrew well over $50,000 from the fund. Although records of the fund’s disbursements have been destroyed, other sources indicate that some of the other recipients of the fund include Magruder; Herbert L. “Bart” Porter, CREEP’s scheduling director; several White House officials; and other unidentified persons not officially part of either CREEP or the Nixon administration. Magruder denies ever receiving any such funds. The General Accounting Office has said that such a fund is a “possible and apparent” violation of a new, stricter campaign finance disclosure law. (Bernstein and Woodward 9/29/1972)
While researching the story that would reveal the extensive “dirty tricks” operations conducted by the Nixon presidential campaign (see June 27, 1971, and Beyond), Washington Post reporter Carl Bernstein learns of the extensive connections between “agent provocateur” Donald Segretti and members of the Nixon administration.
College Connection - Segretti, Nixon press secretary Ron Ziegler, White House appointments secretary Dwight Chapin, and Ziegler’s aide Tim Elbourne had all attended college together at the University of Southern California. All were members of a campus political group called “Trojans for Representative Government.” The group carried out a number of dirty campus political operations, which they called “ratf_cking.” Some of their “tricks” included ballot box stuffing, planting of spies in opposition camps, and spreading of bogus campaign literature designed to drive students away from the targeted candidate.
Campaigns - Ziegler and Chapin had joined Richard Nixon’s gubernatorial campaign in 1962, which was managed by H. R. Haldeman, now Nixon’s closest White House aide. After Nixon lost that election, Ziegler, Chapin, and Elbourne had worked for Haldeman in an advertising agency. Ziegler and Chapin had recruited Segretti and Elbourne to take part in the 1972 Nixon campaign.
Confirmation - A Justice Department official confirms that Segretti is under investigation for political sabotage and espionage operations, and says that he is familiar with the term “ratf_cking.” Bernstein discusses Segretti with a Justice Department attorney, who is outraged at the entire idea. “Ratf_cking?” he snarls. “You can go right to the top with that one. I was shocked when I heard it. I couldn’t believe it. These are public servants? God. It’s nauseating. You’re talking about fellows who come from the best schools in the country. Men who run the government!” The attorney calls the Segretti operation “despicable,” and Segretti himself “indescribable.” “You’re dealing with people who act like this is Dodge City, not the capital of the United States.” The attorney hints that the Nixon campaign “slush fund” (see September 29, 1972) helped pay for the operations, and that the “Canuck letter” (see February 24-25, 1972) was one of the Nixon campaign’s operations.
Mitchell Involved - Bernstein prods the attorney about the phrase “go right to the top,” and mentions former campaign manager John Mitchell. The attorney says of Mitchell: “He can’t say he didn’t know about it, because it was strategy—basic strategy that goes all the way to the top. Higher than him, even.” Woodward is stunned. Higher than Mitchell? The only three people in the Nixon administration higher than Mitchell are Nixon’s top aides, H. R. Haldeman and John Ehrlichman, and Richard Nixon himself. Bernstein and colleague Bob Woodward later write, “For the first time, [Bernstein] considered the possibility that the president of the United States was the head ratf_cker.” (Bernstein and Woodward 1974, pp. 126-129)
Around 2 a.m., Washington Post reporter Bob Woodward meets his FBI source, W. Mark Felt (popularly called “Deep Throat”—see May 31, 2005) in the underground parking garage Felt has designated as their rendezvous (see August 1972). Woodward’s partner Carl Bernstein has unearthed fascinating but puzzling information about a Nixon campaign “dirty tricks” squad headed by California lawyer Donald Segretti (see June 27, 1971, and Beyond and October 7, 1972). Woodward is desperately searching for a way to pull together the disparate threads of the various Watergate stories. An unusually forthcoming Felt says he will not give Woodward any new names, but directs him to look in “the direction of what was called ‘Offensive Security.’” Things “got all out of hand,” Felt tells Woodward, in “heavy-handed operation[s]” that went farther than perhaps their originators had intended. Felt says bluntly that Nixon campaign chairman John Mitchell was involved, and, “Only the president and Mitchell know” how deep Mitchell’s involvement really is. Mitchell “learned some things in those ten days after Watergate,” information that shocked even him. If what Mitchell knows ever comes to light, it could destroy the Nixon administration. Mitchell himself knew he was ruined after Watergate investigation began, and left the administration to try to limit the damage. Felt adds that Nixon aide John Ehrlichman ordered Watergate burglar E. Howard Hunt to leave town (see June 18, 1972), a revelation that surprises Woodward, since Ehrlichman’s name has not yet come up in the conspiracy stories.
Four Major Groups - There are four major groups within the Nixon presidential campaign, Felt says. The “November Group” handles campaign advertising. Another group handles political espionage and sabotage for both the Republican and Democratic National Conventions. A third “primary group” did the same for the campaign primaries (this group not only worked to sabotage Democrats, but Republican primary opponents of Nixon’s as well). And a fourth, the “Howard Hunt group,” is also known as the “Plumbers,” working under Hunt (see 2:30 a.m.June 17, 1972). Felt calls the Plumbers the “really heavy operations team.” Hunt’s group reports directly to Charles Colson, Nixon’s special counsel. One set of operations by Hunt’s group involved planting items in the press; Felt believes Colson and Hunt leaked stories of former Democratic vice presidential candidate Thomas Eagleton’s drunk driving record to reporters. “Total manipulation—that was their goal, with everyone eating at one time or another out of their hands. Even the press.” The Post is specifically being targeted, Felt warns; the White House plans to use the courts to make Woodward and Bernstein divulge their sources.
Watergate Investigation Deliberately Narrow - Felt says that the Justice Department’s indictments against the seven Watergate burglars (see September 15, 1972) was as narrow as Department officials could make it. Evidence of political espionage or illegal campaign finances that was not directly related to the burglary was not considered. Felt says that the investigation, as narrow as it was, was plagued by witness perjury and evasions.
Everything is Interconnected - Everything—surveillance operations, illegal campaign finances, campaign “dirty tricks”—is interconnected, Felt says. The Segretti story is just the tip of the iceberg: “You could write stories from now until Christmas or well beyond that.” The two men have been alternately standing and sitting in the unlighted parking garage for hours; dawn is approaching, and both are exhausted. Woodward knows he needs specifics, the names of these higher-ups. How is he to know if he is not being railroaded down investigative dead ends by White House media manipulation operations? How about the “Canuck letter” that destroyed the candidacy of Democratic presidential hopeful Edmund Muskie? “It was a White House operation,” Felt replies: “done inside the gates surrounding the White House and the Executive Office Building. Is that enough?” It is not, Woodward retorts. Are there more intelligence and sabotage operations still to come? Woodward angrily says that he is tired of their “chickensh_t games,” with Felt pretending he never provided primary information and Woodward contenting himself with scraps of disconnected information. Felt replies: “Okay. This is very serious. You can safely say that 50 people worked for the White House and CREEP [the Nixon re-election campaign] to play games and spy and sabotage and gather intelligence. Some of it is beyond belief, kicking at the opposition in every imaginable way. You already know some of it.” Woodward lists the many examples that he and Bernstein have been able to unearth: surveillance, following people, press leaks, fake letters, campaign sabotage, investigations of campaign workers’ private lives, theft, campaign provacateurs. Felt nods. “It’s all in the [FBI] files. Justice and the Bureau know about it, even though it wasn’t followed up.” Woodward, despite himself, is stunned. The White House had implemented a systematic plan to subvert the entire electoral process? Had used fifty people to do it? “You can safely say more than fifty,” Felt says, and walks up the ramp and out of the garage. It was 6 a.m. Woodward uses Felt’s information to help create one of the most devastating stories yet published about Watergate (see October 10, 1972). 'Organizing Principle' of Watergate - Nixon White House counsel Leonard Garment will write in his 2000 book In Search of Deep Throat (in which he misidentifies the source as obscure Nixon staffer John Sears) that while Woodward’s source did not deliver “much in the way of specific information, he gave Woodward and Bernstein what they needed: an organizing principle.” It is during this time, Garment will write, that the reporters begin to truly understand the entirety of the Watergate conspiracy. (Woodward 2005, pp. 191-194)
Washington Post staff writer Marilyn Berger reports that the deputy director of White House communications, Ken W. Clawson, told her in regards to the infamous “Canuck letter” (see February 24-25, 1972) that sabotaged Democrat Edmund Muskie’s presidential campaign, “I wrote the letter.” Berger says the conversation took place on September 25, over drinks at her apartment.
Woodward Skeptical - Washington Post reporter Bob Woodward is initially dubious; Clawson, a former Post reporter, had joined the White House a mere three weeks before the letter was given to the Union-Leader. But Woodward remembers something a friend had told him about new White House aides being ordered to prove themselves by “screwing an enemy of the White House.” Perhaps the letter was Clawson’s rite of initiation, Woodward reasons. Berger says that Clawson saw nothing morally or ethically wrong with writing such a letter. “That’s politics, that’s the way things are,” he told her. Berger confirms the story during a hastily arranged lunch date with Clawson, but Clawson says he will deny it “on a stack of Bibles over his mother’s grave” if asked. In a phone call to Woodward, Clawson denies writing the letter, and claims that Berger is mistaken. (Bernstein and Woodward 1974, pp. 136-141)
Alleged Author Never Located - The conservative newspaper publisher who printed the letter, William Loeb of the Manchester Union-Leader, says that the letter’s purported author, “Paul Davenport,” has never been located, and though he believes the letter to be authentic, he is now investigating the particulars of the letter because of a letter he has received that alleged someone else was paid $1,000 to assist with the “Canuck hoax.” The editor of the Union-Leader, B. J. McQuaid, says cryptically that Clawson had been “useful” to the paper in connection with the letter. (Bernstein and Woodward 10/10/1972)
FBI agents are now convinced that the Watergate break-in (see 2:30 a.m.June 17, 1972) is one example of actions conducted by a massive campaign of political espionage and sabotage conducted on behalf of the Nixon re-election effort, the Washington Post reports. (Gerald R. Ford Library and Museum 7/3/2007) The efforts, ongoing since at least 1971, were directed at all of the major Democratic presidential contenders, and represent a fundamental strategy of the Nixon re-election effort. The entire conspiracy is, according to FBI and Justice Department information, directed by officials in the Nixon administration and in the Committee to Re-elect the President (CREEP). Hundreds of thousands of dollars have been set aside to pay for what reporters Carl Bernstein and Bob Woodward call “an extensive undercover campaign aimed at discrediting individual Democratic presidential candidates and disrupting their campaigns.” Some of the operations include:
Following members of Democratic candidates’ families and assembling files on their personal lives (former Democratic presidential candidate Edmund Muskie tells reporter Carl Bernstein that his children were followed and that inquiries about them had been made at their school, but cannot be sure that it was Nixon campaign agents doing the surveillance; Bernstein will report this and other Muskie campaign allegations on October 12).
Forging letters and distributing them under the candidates’ letterheads.
Leaking false and fabricated items to the press (Bernstein’s October 12 story includes an item about false allegations of sexual misconduct against Democrats Hubert Humphrey and Henry Jackson).
Sabotaging Democrats’ campaign schedules with planned disruptions (see June 27, 1971, and Beyond).
Stealing confidential campaign files.
Investigating the lives of dozens of Democratic campaign workers.
Planting “provocateurs” in organizations expected to demonstrate at the Democratic and Republican national conventions.
Investigating potential donors to the Nixon campaign before approaching them for money.
A CREEP spokesman calls the allegations “not only fiction but a collection of absurdities,” and notes that “the entire matter is in the hands of the authorities.” Perhaps the best-known example of CREEP political sabotage is the so-called “Canuck letter” (see (February 24-25, 1972). The letter was apparently written by White House official Ken Clawson, who denies writing the letter (see October 10, 1972). (Bernstein and Woodward 10/10/1972) Washington Post reporter Bob Woodward, who co-writes the story, uses information from his “Deep Throat” FBI source (see October 9, 1972) to pen what he later recalls as a much more “aggressive, interpretive” story than he and colleague Carl Bernstein have ever written before. White House press secretary Ron Ziegler refuses to answer questions about the story 29 separate times in a press conference held just after the story is published. Woodward later writes that he is astonished the FBI never responded to the story, even though information sourced from the bureau is heavily cited throughout the story. Woodward later learns that the FBI had repeatedly declined to investigate Segretti. (Bernstein and Woodward 1974, pp. 149-150; Woodward 2005, pp. 75-81)
Washington Post reporter Bob Woodward is phoned by a Post reporter in Los Angeles, Robert Meyers. Meyers has spoken with a fraternity brother of Nixon campaign operative Donald Segretti (see June 27, 1971, and Beyond). The fraternity brother, Larry Young, told Meyers that the FBI learned of Segretti and his campaign operations through the phone records of Watergate burglar E. Howard Hunt (see 2:30 a.m.June 17, 1972). Hunt had called Segretti numerous times to give Segretti instructions about something Young does not know, but “it wasn’t the [campaign] bugging.” Woodward had not known of any Segretti-Hunt connection. Young told Meyers that Segretti admitted working for “a wealthy California Republican lawyer with national connections and I get paid by a special lawyer’s trust fund.” Woodward believes the lawyer in question is Herbert Kalmbach, President Nixon’s personal lawyer; Meyers had asked Young about Kalmbach, but Young did not recognize the name. He does identify the lawyer as having an office in Newport Beach, where Kalmbach has his office. Young believes that Segretti met with both Hunt and White House aide Dwight Chapin (see October 7, 1972). Segretti often talked of going to Miami—the home of most of the Watergate burglars—to meet with Hunt and Chapin. Segretti told Young that when he was in Miami, someone Segretti didn’t identify asked him to organize a group of young Cubans to mount an assault on the Doral Beach Hotel, the location of the Republican National Convention, and make it look as if the Cubans were McGovern campaign workers. Segretti refused to carry out this particular idea, calling it blatantly illegal and violent. Woodward is aware that just such an assault had indeed taken place at the hotel, and that many suspected that there were Republican provocateurs in the crowd of protesters.
Segretti Worried about Being the Fall Guy - When the FBI first contacted Segretti, two weeks before the July convention, Young says that Segretti was shocked that he had not been given advance warning. Segretti worried that he was being set up as a fall guy. In his testimony to the FBI and before the Watergate grand jury, Segretti told them about his connections with Hunt and Chapin, and named the lawyer who paid him. So, Woodward muses, the Justice Department had known of the connections between Segretti, Hunt, and Chapin since June and had not followed up on them. Young agrees to go on the record as a source, and Woodward confirms the story through a Justice Department lawyer. The FBI didn’t consider what Segretti did to be strictly illegal, the lawyer tells Woodward, but “I’m worried about the case. The Bureau is acting funny… there is interest in the case at the top.… [W]e’re not pursuing it.” The lawyer refuses to be more specific. Chapin carefully denies the story. He admits he and Segretti are old college buddies, and does not directly deny that he was Segretti’s White House contact.
Haldeman Connection - A former Nixon administration official tells Woodward, “If Dwight has anything to do with this, it means Haldeman,” referring to Nixon’s chief of staff H. R. Haldeman. “He does what two people tell him to do: Haldeman and Nixon.” The Post story runs on October 15, without naming Kalmbach. The story breaks two new areas of ground: it is the first of its kind to rely on on-the-record sources (Young), and it is the first to directly allege that the Watergate conspiracy reaches into the White House itself and not merely the Nixon re-election campaign. A Time magazine follow-up adds that Chapin had hired Segretti, and names Gordon Strachan, a political aide to Haldeman, had taken part in hiring Segretti as well. Most importantly, Time names Kalmbach as the lawyer who paid Segretti. Irate at being scooped, Woodward quickly confirms Kalmbach’s status as paymaster with a Justice Department attorney, and in a conversation with former campaign treasurer Hugh Sloan, confirms that Segretti was paid out of the campaign’s “slush fund” managed by campaign finance chief Maurice Stans (see September 29, 1972). Kalmbach had distributed far more money than was given to Segretti, Sloan says. (Bernstein and Woodward 1974, pp. 150-159)
Verified - On October 18, the New York Times runs a story that uses telephone records to verify Segretti’s calls from Hunt. (Bernstein and Woodward 1974, pp. 167)
The White House, the Nixon re-election campaign, and Republican supporters begin publicly attacking the Washington Post over its Watergate coverage.
'Character Assassination' - White House press secretary Ron Ziegler says, when asked about the Watergate conspiracy: “I will not dignify with comment stories based on hearsay, character assassination, innuendo or guilt by association.… The president is concerned about the technique being applied by the opposition in the stories themselves.… The opposition has been making charges which have not been substantiated.” Ziegler later calls the Post reports “a blatant effort at character assassination that I do not think has been witnessed in the political process in some time.”
'Political Garbage' - The chairman of the Republican National Committee, Senator Robert Dole (R-KS) attacks what he calls “political garbage” printed about Watergate: “The Washington Post is conducting itself by journalistic standards that would cause mass resignations on principle from the Quicksilver Times, a local underground newspaper,” and accuses the Post of essentially working for the Democrats. (Six months after his attacks, Dole will say that the credibility of the Nixon administration is “zilch, zero.” Years later, Dole will apologize to Post reporter Bob Woodward for his comments.)
CREEP Accusations - Clark MacGregor, the chairman of the Committee to Re-elect the President (CREEP), holds a press conference to say, “The Post has maliciously sought to give the appearance of a direct connection between the White House and the Watergate—a charge the Post knows—and a half dozen investigations have found—to be false.” (MacGregor fields angry questions from the gathered reporters, some of whom bluntly challenge his credibility and his truthfulness, with stoicism, refusing to answer any of them, and instead sticking with his prepared statement.) MacGregor demands to know why the Post hasn’t investigated apparent campaign “dirty tricks” carried out against the Nixon campaign. Like Dole, MacGregor accuses the Post of collaborating with the Democrats, and even charges that Democratic presidential candidate George McGovern encouraged former defense analyst Daniel Ellsberg to leak the “Pentagon Papers” to the press (see March 1971).
Post Thinks Campaign Orchestrated by White House - Post executive editor Ben Bradlee, examining the statements by Ziegler, Dole, and MacGregor, is certain that the entire attack was orchestrated by the White House and perhaps by President Nixon himself. Bradlee issues a statement saying that everything the Post has reported on Watergate is factual and “unchallenged by contrary evidence.” He tells reporters Carl Bernstein and Bob Woodward that “this is the hardest hardball that has ever been played in this town,” and warns them to keep out of any compromising situations that could be used by the White House to challenge their credibility. After Nixon’s landslide presidential victory (see November 7, 1972), the attacks continue. Senior White House aide Charles Colson says, “The charge of subverting the whole political process, that is a fantasy, a work of fiction rivaling only Gone With the Wind in circulation and Portnoy’s Complaint for indecency.” (Stern and Johnson 5/1/1973; Bernstein and Woodward 1974, pp. 161-166; Woodward 2005, pp. 83-84)
President Nixon meets in his hideaway office in the Executive Office Building with his chief of staff, H. R. Haldeman. Their conversation is captured on Nixon’s secret taping system (see July 13-16, 1973). Haldeman reports that he has learned from his own secret source that there is a leak in the highest echelons of the FBI, a source apparently funnelling information to Washington Post reporters Bob Woodward and Carl Bernstein: “Mark Felt.” Felt, the deputy director of the bureau, is Woodward’s clandestine background source “Deep Throat” (see May 31, 2005). Haldeman warns Nixon not to say anything because it would reveal Haldeman’s source, apparently some “legal guy” at the Post. Besides, “[I]f we move on [Felt], he’ll go out and unload everything. He knows everything that’s to be known in the FBI.” According to White House counsel John Dean, there are no legal sanctions that can be taken against Felt, because Felt has broken no laws. Dean is worried that if the White House takes any action, Felt will “go out and get himself on network television.” Nixon snarls: “You know what I’ll do with him, the little b_stard. Well, that’s all I want to hear about it.” Haldeman tells Nixon that Felt wants to be director of the FBI. Nixon’s first question: “Is he Catholic?” “No sir, he’s Jewish,” Haldeman replies. “Christ, put a Jew in there?” Nixon asks. “Well, that could explain it too,” Haldeman observes. (Woodward 2005, pp. 85-86) Acting director L. Patrick Gray will inform Felt of the White House’s suspicions in early 1973, leading Felt to strenuously deny the charge, but Gray will refuse White House demands to fire Felt. (Woodward 2005, pp. 139)
Washington Post reporter Bob Woodward runs into difficulty with his FBI source, W. Mark Felt, the infamous “Deep Throat” (see May 31, 2005). Woodward wants information connecting Nixon’s chief of staff, H. R. Haldeman, to the Nixon campaign “slush fund” (see Early 1970), but Felt, apparently afraid of crossing Haldeman (see October 19, 1972), refuses to provide anything specific.
Origin of Error - Woodward and his colleague, Carl Bernstein, attempt to secure confirmation of Haldeman’s role in Watergate through the treasurer of the Nixon campaign’s secret fund (see September 29, 1972), Hugh Sloan. The reporters misinterpret Sloan’s cautious statements as indirect confirmation that Sloan had testified to the FBI of Haldeman’s involvement. Additionally, they misinterpret guarded “confirmations” from two other sources. On October 25, the Post publishes a story about Sloan’s supposed assertions.
'All Hell Broke Lose' - Sloan’s attorney denies that his client ever made such an assertion in his testimony (Sloan will later confirm that Haldeman was indeed in charge of the secret fund, but he never testified to that fact). As Woodward later writes, “All hell broke loose.” Woodward and his partner Carl Bernstein, both clearly upset, offer to resign from the Post, an offer that is refused. The White House celebrates the error, calling into question every story Bernstein and Woodward wrote for the Post; Republican supporters such as Senator Bob Dole (R-KS) join in. Post executive editor Ben Bradlee—who stands by the story—will later say that the erroneous story is his personal low point in the history of the entire Watergate coverage.
Repercussions - Felt is furious with Woodward for the erroneous story. They may have lost Haldeman, Felt says, and worse, have spooked other sources that might otherwise have come forward. “You’ve got people feeling sorry for Haldeman. I didn’t think that was possible.… You put the investigation back months. It puts everyone on the defensive—editors, FBI agents, everybody has to go into a crouch after this.” The reporters write another story admitting the error about Sloan’s testimony, but saying that Haldeman did indeed control the secret campaign fund. Woodward even quotes Felt, identifying him as “one source,” an unprecedented breach of the procedures they have established in using Felt as a “deep background” source. (Bernstein and Woodward 1974, pp. 173-196; Woodward 2005, pp. 88-92)
The trial of the seven men accusing of breaking into Democratic headquarters at the Watergate hotel and office complex (see 2:30 a.m.June 17, 1972) begins. Defendant G. Gordon Liddy is confident to the point of exuberance, waving triumphantly to the jurors; the other defendants are more subdued. Prosecutor Earl Silbert’s opening argument presents a scenario in which Liddy had been given money for legitimate political intelligence-gathering purposes, and on his own decided to mount illegal operations. Washington Post reporter Bob Woodward, observing in the courtroom, is dismayed; Silbert is giving the jury the “Liddy-as-fall-guy” tale Woodward and his colleague Carl Bernstein had learned of months before, and which Nixon and his aides had discussed in June (see June 21, 1972). After Silbert’s opening argument, Hunt abruptly changes his plea to guilty; the four Miami-based burglars—Bernard Barker, Virgilio Gonzalez, Eugenio Martinez, and Frank Sturgis—soon follow suit (see January 10, 1973). After the first day of testimony in the Watergate trial (see January 8-11, 1973), Washington Post reporter Carl Bernstein piles into a taxicab with the four Miami-based Watergate burglars and their lawyer, and accompanies them to the airport and even onto the plane one of them is taking in order to have a conversation—an impromptu interview—with one of the men. (In the book All the President’s Men, Bernstein does not identify the subject of the conversation.) The airborne conversation flows with surprising ease. Bernstein learns that E. Howard Hunt has been pressuring the others for a week to plead guilty; their families will be cared for financially, and they will certainly receive some sort of executive clemency within a few months. Hunt is once again serving as a “case officer” giving orders to his lower-level operatives. Their lawyer, Henry Rothblatt (see Early January, 1973), is furious, and has instructed his clients to “stay away from that son of a b_tch Hunt.” (Hunt’s lawyer, William Bittman, denies that Hunt pressured anyone to do anything.) Bernstein, colleague Bob Woodward, and Post editors are leery of publishing the story, worrying that the trial judge, John Sirica, might consider the interview a possible obstruction of justice or interference with the trial. The next day, the New York Times’s Seymour Hersh prints a story that says burglar Frank Sturgis believes former Nixon campaign chief John Mitchell knew about, and even encouraged, the Watergate operation. Time magazine claims that the four Miami burglars will receive $1,000 a month for their jail sentences. And columnist Jack Anderson writes that campaign money for the defendants is being funneled through burglar E. Howard Hunt. Emboldened by the other stories, the Post prints Bernstein’s story. (Bernstein and Woodward 1974, pp. 232-233)
After the press reports that the Watergate burglars will receive cash payments in return for their guilty pleas and their silence (see January 8-9, 1973 and January 8-11, 1973), Judge John Sirica angrily grills the four Miami-based defendants in court about the claims. To a man, they deny any pressure to plead guilty, any knowledge of cash payments to themselves or their families, and any knowledge of discussions of possible executive clemency. Defendant Virgilio Gonzalez even denies being a former CIA agent, when evidence has already established that he was on a $100/month retainer by the agency until the day after the Watergate burglary. (Defendant G. Gordon Liddy laughs aloud when Gonzalez makes this claim.) Gonzalez claims that the entire Watergate operation was somehow involved with the Communist regime of Cuba: Gonzalez says he is committed to “protect[ing] this country against any Communist conspiracy.” Sirica rolls his eyes in disbelief. Gonzalez claims not to know any specifics of the supposed connection between the Democrats and Castro’s Cuba, and says that he trusted the judgement of his superiors, Liddy and E. Howard Hunt. Fellow defendant Bernard Barker claims that none of them were paid for their actions: “These are not men that sell themselves for money,” Barker states. Barker confirms that he worked for Hunt, and says it was an honor for him to perform such a service. Washington Post reporters Carl Bernstein and Bob Woodward later write, “The prosecutors’ assurances that everything would come out at the trial were fading into nothingness, as the defendants ducked into the haze of their guilty pleas.” The five who pled guilty are led off to jail before their bail and sentencing hearings. (Bernstein and Woodward 1974, pp. 233-235; Gerald R. Ford Library and Museum 7/3/2007) In his Watergate grand jury testimony, White House counsel John Dean will say that President Nixon approved executive clemency for Hunt in December 1972 (see January 10, 1973). (Bernstein and Woodward 1974, pp. 312) In 1974, Barker will write that while in jail, James McCord is their group leader, but they do not fully trust him, partly because he is “very friendly with Alfred Baldwin, and to us Baldwin was the first informer” (see May 29, 1972). Another disconnection between McCord and the Cubans is his lack of participation in the Ellsberg burglary (see September 9, 1971). (Martinez and Barker 10/1974)
During the Watergate trial of G. Gordon Liddy and James McCord (see January 30, 1973), Washington Post reporters Carl Bernstein and Bob Woodward begin poring over the exhibits and papers filed as evidence with the court. Woodward begins calling the phone numbers listed in the address books of the burglars (see June 18, 1972). He is told by one of the first people he calls: “The FBI? They never, never contacted me. I never talked to them.” Woodward is appalled that the FBI has made such a fundamental investigative failure of not calling all of the people listed in the books. (An FBI internal report will later attempt to explain the lapse—see July 5, 1974.)
Woodward Calls Witnesses - When the court releases the names of upcoming witnesses, Woodward begins calling them, too. He asks one witness, who knows burglar E. Howard Hunt (see January 8-9, 1973) very well, what he will testify to. “I’ll tell you what I could testify to, but [prosecutor Earl] Silbert won’t ask,” the witness replies. “If the judge does or any of the attorneys, I’ll say it.” The witness has already told everything he knows to Silbert and FBI investigators.
Ehrlichman Allegedly Ran Plumbers - He says that if asked, he would tell the court that, according to Hunt, White House aide John Ehrlichman was in charge of the Plumbers (see December 7, 1972). Hunt would have rather dealt with another White House aide, Charles Colson, “because Colson understood that such [secret intelligence gathering operations against political opponents] are necessary.” Ehrlichman was reluctant to implement some of Hunt’s schemes, the witness says, but Colson pushed them through. Former Nixon campaign chief John Mitchell received typed logs and reports of the wiretaps on the Democrats, the witness says.
Conspiracy Linked to Dean - Most surprisingly for Woodward, the witness says that when Hunt was in hiding from investigators (see June 18, 1972) and demanding a lawyer, he insisted that White House counsel John Dean find him one. This is the first time anyone has publicly connected Dean to the Watergate conspiracy.
Not Asked - As the witness predicts, he will not be asked any of this when he testifies. Woodward and Bernstein write a long analysis of the trial, headlined “Still Secret: Who Hired Spies and Why,” observing that the Liddy/McCord trial is notable for “questions that were not asked, answers that were not given, witnesses who were not called to testify, and some lapses of memory by those who were.” At the bond hearing for Liddy and McCord after the trial, Judge John Sirica will say that he hopes the proposed Senate investigation (see February 7, 1973) can find out what the trials did not. (Bernstein and Woodward 1974, pp. 237-241)
Washington Post reporter Bob Woodward once again meets with his FBI background source, W. Mark Felt—known around the Post offices as “Deep Throat” (see May 31, 2005). Felt says that everyone in the FBI knows, or is convinced, that former Nixon campaign chief John Mitchell and White House aide Charles Colson were the driving forces behind the “Plumbers,” the “special investigative unit” that carried out illegal surveillance and burglaries for the Nixon re-election campaign (see Late June-July 1971). “Colson’s role was active,” Felt says. “Mitchell’s position was more ‘amoral’ and less active—giving the nod but not conceiving the scheme.” While no one at the bureau doubts this, Felt says, there is only “the weakest circumstantial evidence” to prove it. “‘Insulation’ is the key word to understand why the evidence can’t be developed.” He adds, perhaps challengingly, “If the FBI couldn’t prove it, I don’t think the Washington Post can.” Mitchell and Colson sponsored convicted Watergate burglars G. Gordon Liddy and E. Howard Hunt, Felt says. “And if you’ll check, you’ll find that Liddy and Hunt had reputations that are the lowest. The absolute lowest. Hiring these two was immoral. They got exactly what they wanted. Liddy wanted to tap the New York Times and everybody knew it. And not everybody was laughing about it. Mitchell, among others, liked the idea.” (The scheme to wiretap the Times was never carried out.) With the convictions of the burglars (see January 8-11, 1973 and January 30, 1973), the White House’s plan now is to contain the damage and prevent any congressional hearings from finding out anything further. The key to the damage-control plan, Felt says, is the broad claim of presidential “executive privilege” to keep investigators from subpoenaing White House records. Someone from inside the conspiracy is going to have to crack, Felt says, or there will never be more than rumor and circumstantial evidence that will prove nothing. Felt is disgusted with the FBI investigation’s deliberate narrowness (see Mid-January, 1973), saying that it could have gone far deeper and farther afield than it did. “The efforts to separate the Watergate and the espionage-sabotage operations are a lot of bullsh_t,” he says. After heated discussions over Felt’s latest revelations, Woodward and his colleague Carl Bernstein decide there is not enough concrete evidence for a new story. (Bernstein and Woodward 1974, pp. 243-246)
The US Senate votes 77-0 to create the Select Committee on Presidential Activities, which comes to be known as the Senate Watergate Committee. The chairman is Sam Ervin (D-NC), whose carefully cultivated image as a folksy “country lawyer” camouflages a keen legal mind. Ervin’s deputy is Howard Baker (R-TN). (Gerald R. Ford Library and Museum 7/3/2007) Senate Republicans attempt to dilute the effectiveness of the investigative committee with resolutions demanding probes into the 1964 and 1968 elections as well—Hugh Scott (R-PA) says there is “wholesale evidence of wiretapping against the Republicans” in the 1968 campaign, yet refuses to present any evidence—but those resolutions fail in floor votes. After the vote, Washington Post reporter Bob Woodward learns that the resolutions were drafted by White House lawyers. (Bernstein and Woodward 1974, pp. 250-251) Ervin, already chosen to head the committee, told fellow senator Edward Kennedy (D-MA), who held his own ineffective senatorial investigation, that he knew little more about the Watergate conspiracy than what he read in the papers, but “I know the people around [President] Nixon, and that’s enough. They’re thugs.” (Bernstein and Woodward 1974, pp. 247) Ervin has already contacted Woodward and asked him to help him compile information. Ervin implies that he wants Woodward to convince his unnamed sources to come forward and testify. Woodward demurs, but he and colleague Carl Bernstein write a story reporting Ervin’s intention to call President Nixon’s top aides, including H. R. Haldeman, to testify. (Woodward 2005, pp. 93-94) Woodward does suggest that Ervin should take a hard look at the secret campaign “slush fund” (see Early 1970 and September 29, 1972), and that everything he and Bernstein have found points to a massive undercover operation led by Haldeman. (Bernstein and Woodward 1974, pp. 247-249)
Washington Post reporter Bob Woodward meets with W. Mark Felt, his secretive “Deep Throat” FBI source (see May 31, 2005), at an out-of-the-way bar in Maryland. During the meeting, Felt warns Woodward that the FBI is up in arms about finding the source, or sources, of news leaks about Watergate. The Nixon campaign lawsuit and subpoenas to Woodward and other reporters (see February 26, 1973) are “only the first step” in an all-out White House campaign against the press in general and the Post in particular. Felt says that Nixon has “told the appropriate people, ‘Go to any length’ to stop them. When he says that, he really means business.” There is about $5 million left in the Nixon campaign fund from the 1972 elections, and Nixon intends to use that money to, as Felt says, “take the Washington Post down a notch.” A full-blown grand jury investigation of the Watergate leaks is being planned, Felt says. Felt describes Nixon as “wild” and “shouting” about the idea. “He thinks the press is out to get him and therefore is disloyal; people who talk to the press are even worse—the enemies within, or something like that.” Felt seems surprisingly unconcerned, and explains that he feels the Nixon administration is, in Woodward’s words, “on the ropes.” “It can’t work. They’ll never get anyone. They never have. They’re hiding things that will come out and even discredit their war against leaks. They can’t stop the real story from coming out. That’s why they’re so desperate.… The flood is coming, I’m telling you.” Felt says that all of this is why L. Patrick Gray pressured the White House into naming him as permanent FBI director (see February 17, 1973), so he could help contain the leaks and ensure that the press never learns the true extent of Watergate. Felt also strongly implies that the Gray nomination is the result of implicit blackmail on Gray’s part—name him FBI director or, as Felt puts it, “all hell could break loose.” Gray and White House counsel John Dean will later deny this. (Bernstein and Woodward 1974, pp. 268-270; Woodward 2005, pp. 12-13)
An internal FBI memo shows that the bureau suspects one of its own as being a source for Washington Post reporters Bob Woodward and Carl Bernstein for Watergate-related information. The memo reads in part: “As you know, Woodward and Bernstein have written numerous articles about Watergate [in which] they have frequently set forth information which they attribute to Federal investigators, Department of Justice sources and FBI sources.… [T]here is no question but that they have access to sources either in the FBI or the Department of Justice.” The memo says that the FBI’s acting director, L. Patrick Gray, has ordered an analysis of the reporters’ most recent article to determine its source and to locate the FBI leaker. The memo is signed by W. Mark Felt, the FBI’s deputy director and Woodward’s infamous source, nicknamed in the Post newsroom “Deep Throat” (see May 31, 2005). Woodward, who will read the memo for the first time in 1992, will realize as he pores over the document that Felt used the memo to cover his own tracks, not only by initiating the leak inquiry but by casting suspicion, however briefly, on US Attorney Donald Campbell. (Woodward 2005, pp. 7-11)
The Committee to Re-elect the President (CREEP) files a lawsuit against the Washington Post, the Washington Star-News, the New York Times, and Time magazine, demanding that the various news outlets be forced to reveal their notes and sources regarding the Watergate investigation. Washington Post reporters Carl Bernstein, Bob Woodward, and Jim Mann are subpoenaed, as are editor Howard Simons and publisher Katherine Graham. The young law student who delivers the subpoena to Bernstein, a part-time employee in CREEP lawyer Kenneth Parkinson’s firm, is not happy with the proceedings, and promises to give Bernstein any information he might develop. (Bernstein and Woodward 1974, pp. 260-261)
Washington Post reporter Bob Woodward is steered to a George Washington University student named Craig Hillegass. The student tells Woodward that his fraternity brother, Theodore Brill, was paid $150 a week by the Committee to Re-elect the President (CREEP) to infiltrate the group of Quakers who maintain a 24-hour a day “peace vigil” in front of the White House. Brill reported information on the protesters’ demonstration plans and personal lives, and then helped plan and execute raids for drug possession. The Washington police eventually did raid the vigil, but found nothing. Brill, the chairman of GWU’s Young Republicans chapter, was terminated by CREEP two days after the Watergate burglary (see 2:30 a.m.June 17, 1972). “The idea,” Hillegass tells Woodward, “was to create an embarrassment to the Democrats, because any embarrassment to radical groups would be considered an embarrassment to liberal politics and Senator [George] McGovern,” the Democratic presidential candidate in 1972 (see November 7, 1972). Hillegass recalls that the method of paying Brill was almost cartoonish in its covert nature: “Ted said he once was told to meet a woman in a red dress with a white carnation, carrying a newspaper. He exchanged his written report for an envelope containing his pay.” Woodward is most interested in Hillegass’s recollection that Brill’s campaign “dirty tricks” were connected to higher-level officials in CREEP—and the number of other “agents provacateurs” being employed by the campaign. Donald Segretti (see June 27, 1971, and Beyond) was only one of 50 or so provacateurs employed by the campaign, and the Post has always wanted to know who the other 49 were. Brill was definitely small fry, but, Woodward believes, part of a larger pattern. When Woodward speaks with Brill himself, the student confirms his former job with CREEP, and says that he was hired by George Gorton, CREEP’s national youth director. He was paid five times—four times in cash and once with Gorton’s personal check, never in a way that could be traced back to the campaign. Brill says he was supposed to go to Miami and join other campaign operatives in similar operations to the Quaker infiltration, but the Watergate burglary brought that to an abrupt close. Gorton confirms that Brill worked for him in the campaign, but denies he or Brill ever did anything illegal. Interestingly, Gorton initially boasts that he had people gathering information on “radicals” in 38 states, then backs off and says Brill was his only operative. Gorton says he reported to Kenneth Rietz, the director of CREEP’s Youth Vote Division. Rietz had been recommended by H. R. Haldeman to take over as the head of the Republican National Committee. The Posts prints a story based on Woodward’s information, and notes that Brill’s salary was not reported in CREEP’s financial disclosures. The General Accounting Office (GAO) will audit CREEP’s finances and discover that the campaign had maintained a clandestine “Kiddie Corps” of young spies working around the country. (Bernstein and Woodward 1974, pp. 262-265)
Acting FBI director L. Patrick Gray, mired in contentious Senate hearings about his nomination to permanently take the position (see February 28-29, 1973), says that contrary to media reports, White House counsel John Dean took nothing from the safe of Watergate burglar E. Howard Hunt. The White House issues a statement making the same claim. But Gray’s claims are critically undermined by another revelation. In FBI documents released to the Senate by Gray as part of his testimony, and subsequently made available to the public, one document catches the eye of reporters: a memo titled “Interview with Herbert W. Kalmbach.” Kalmbach, President Nixon’s personal lawyer, said in the interview that in August or September 1971, he had obeyed instructions from Nixon aide Dwight Chapin to hire Nixon campaign operator Donald Segretti (see June 27, 1971, and Beyond) and pay Segretti for his services. The interview guts the White House’s claim that it never hired any such agents provacateurs as Segretti, destroys Gray’s (and the FBI’s) credibility with many senators, and vindicates the media’s reporting on the broader Watergate conspiracy. The atmosphere at the Washington Post is jubilant. Post reporters Carl Bernstein and Bob Woodward put together a scathing news analysis based on the discovery, using quote after quote from administration sources and pairing each quote with information disproving the administration claims. Unfortunately, the reporters later write, the article is unintentionally “packaged like an ax murder,” with a row of pictures of Nixon officials that resemble a lineup of mug shots. White House officials later tell the reporters that this single story garners a tremendous amount of hatred and resentment among Nixon officials. (Bernstein and Woodward 1974, pp. 273-274; Woodward 2005, pp. 13-14)
Convicted Watergate burglar James McCord testifies behind closed doors to the Senate Watergate Committee (see March 25, 1973). The committee’s ranking minority member, Howard Baker (R-TN), tells reporters after the lengthy session that McCord has provided “significant information… covering a lot of territory.” One senator anonymously tells Washington Post reporters Carl Bernstein and Bob Woodward of McCord’s testimony: McCord has told the senators that fellow Watergate burglar G. Gordon Liddy said the burglary and surveillance operation was approved by then-Nixon campaign chairman John Mitchell in February 1972, while Mitchell was still attorney general (see March 20, 1971). In addition, McCord told the senators that White House aide Charles Colson knew about the Watergate operation in advance. Little of this is news to the Post reporters, and they are not heartened by Baker’s admission that McCord’s testimony is almost all secondhand information. (Bernstein and Woodward 1974, pp. 280-281)
The New York Times reports that convicted Watergate burglar James McCord told the Senate Watergate Committee (see March 28, 1973) that the cash payoffs for the burglars came directly from the Nixon re-election campaign (CREEP). McCord’s testimony is the first confirmation that CREEP bought the silence of the burglars during their trial (see January 8-11, 1973). Washington Post reporter Bob Woodward, attempting to confirm earlier information that the CREEP “slush fund” had continued to operate well after the Watergate burglaries (see 2:30 a.m.June 17, 1972), speaks to a CREEP official; the official explodes about the reaction among his colleagues to McCord’s testimony. “John Mitchell [the former head of CREEP] still sits there smoking on his pipe, not saying much… I used to take that for wisdom—you know, keeping your mouth shut. Now I realize that it’s ignorance.… God, I never thought I’d be telling you guys that I didn’t hate what you did. It’s the way the White House has handled this mess that’s undermined the presidency.… I’ve got friends who look at me now and say, ‘How can you have any self-respect and still work for CREEP?’ I’m sick.” Former CREEP treasurer Hugh Sloan confirms that at least $70,000 of the “slush fund” money (see Early 1970 and September 29, 1972)was used to pay off the burglars, all with the approval of CREEP financial director Maurice Stans. Woodward and colleague Carl Bernstein will later write: “That tied the knot. The secret fund had brought the reporters full circle—first the bugging, and now the cover-up.” (Bernstein and Woodward 1974, pp. 282-284)
Washington Post reporters Carl Bernstein and Bob Woodward receive top awards at the annual White House Correspondents Association dinner for their early Watergate reporting. President Nixon and a coterie of staffers attend, and Nixon, speaking to the assemblage, draws some laughs when he opens with the line, “It is a privilege to be here… I suppose I should say it is an executive privilege.” He pays tribute to the founder of US News and World Report, David Lawrence, who had recently died, saying, “David Lawrence, who was a charter member of this club 59 years ago, said to me a couple of years ago, ‘There is only one more difficult task than being president of this country when we are waging war, and that is to be the president when we are waging peace.’” After the dinner, Nixon asks chief of staff H. R. Haldeman, “What did you think of the Lawrence quote?” Haldeman replies, “Appropriate.” Nixon says, “I made it up.” (Reeves 2001, pp. 586)
Former CREEP deputy director Jeb Magruder testifies in private to investigators for the Watergate investigation. Washington Post reporter Bob Woodward learns of Magruder’s testimony on April 18, from a CREEP official. The official tells Woodward that “Magruder is your next McCord (see March 28, 1973). He went to the prosecutors last Saturday [April 14] and really tucked it to [John] Dean and [John] Mitchell.” Woodward asks why Magruder, who has a reputation for extreme loyalty, would testify against anyone in either the White House or the campaign. “Bad sh_t, man,” the official responds. “The walls were coming in on him—walls, ceiling, floor, everything.” Magruder blamed Dean and Mitchell for “[t]he whole mess,” says the official, “the bugging plans and the payoff scheme… those meetings, or at least one meeting, in Mitchell’s office when everything was discussed with [G. Gordon] Liddy before the bugging.” Woodward confirms the official’s account with a White House official, who says that Magruder told everything he knew: “The works—all the plans for the bugging, the charts, the payoffs.… This is no hearsay like McCord. It will put Dean and Mitchell in jail.” Magruder’s lawyer confirms that his client will testify before the grand jury when called. And a Justice Department official adds that “other people will testify that Mitchell and Dean were in on the arrangements for the payoffs.” (Bernstein and Woodward 1974, pp. 292-293) The same day, Magruder admits to Bart Porter, the campaign’s director of scheduling, that he has been using Porter to help cover his own involvement in the Watergate conspiracy (see July 31, 1972). Porter, who has lied three times under oath for Magruder (see January 8-11, 1973), is horrified. He decides to stop lying for Magruder or anyone else, and tell the Senate Watergate Committee everything he knows about Watergate, regardless of the consequences. (Porter 10/1974)
After learning that the White House will soon make a dramatic Watergate admission, Washington Post reporter Bob Woodward meets clandestinely with his “Deep Throat” source, FBI deputy director W. Mark Felt (see May 31, 2005). Felt drops a bombshell. “You’d better hang on for this,” he says. “Dean and Haldeman are out—for sure” (see April 30, 1973). John Dean is President Nixon’s White House counsel and one of the key figures in the Watergate conspiracy. H. R. Haldeman is Nixon’s chief of staff and closest confidante. “Out. They’ll resign. There’s no way the president can avoid it.” Woodward and his colleague Carl Bernstein inform Post editor Ben Bradlee of Felt’s revelation (avoiding any identification of Felt). Bradlee is reluctant to print such an explosive story based on one “deep background” source, no matter how reliable. The story does not go to print. (Woodward 2005, pp. 75-81) Felt’s story is accurate as far as it goes. The day before, Attorney General Richard Kleindienst had informed President Nixon that Dean and former campaign deputy Jeb Magruder testified, and that they named Haldeman, White House aide John Ehrlichman, and former campaign chief John Mitchell as co-conspirators. Dean went even further, demanding complete immunity and threatening to implicate Nixon if he was not given legal protection. Kleindienst says he will have to recuse himself from further involvement in the investigation because of his close relationship with Mitchell (see April 19, 1973), but deputy attorney general Henry Peterson will keep Nixon informed of any and all events that transpire. (Reeves 2001, pp. 586-587) It is not clear if Felt knew that Mitchell and Ehrlichman had also been implicated; in any event, he does not inform Woodward. (Woodward 2005, pp. 75-81)
The New York Daily News reports that acting FBI director L. Patrick Gray destroyed potentially incriminating evidence taken from the safe of Watergate burglar E. Howard Hunt (see Late December 1972). Gray, who testified to this days before to the Watergate grand jury, said that he received the material from White House counsel John Dean. “I said early in the game,” Gray testifies, “that Watergate would be a spreading stain that would tarnish everyone with whom it came in contact—and I’m no exception.” Shortly afterwards, Washington Post reporter Bob Woodward learns from his “Deep Throat” source, FBI deputy director W. Mark Felt (see May 31, 2005), that the story is true. Felt informs Woodward that Gray was told by Nixon aides Dean and John Ehrlichman that the files were “political dynamite” that could do more damage to the Nixon administration than Watergate (see June 28, 1972). Woodward realizes that the story means Gray’s career at the FBI is finished. Woodward and his colleague Carl Bernstein write their own report for April 30; the same day, Gray resigns from the FBI (see April 5, 1973). Instead of Felt being named FBI director, as he had hoped, Nixon appoints the head of the Environmental Protection Agency, William Ruckelshaus, to head the bureau. Felt is keenly disappointed. (Time 8/20/1973; O.T. Jacobson 7/5/1974 ; Woodward 2005, pp. 96-98) When he learns of Gray’s actions, Post editor Howard Simons muses: “A director of the FBI destroying evidence? I never thought it could happen.” (Bernstein and Woodward 1974, pp. 306-307) The FBI’s 1974 report on its Watergate investigation dates Gray’s resignation as April 27, not April 29 (O.T. Jacobson 7/5/1974 ) , a date supported by reports from Time. (Time 8/20/1973)
Washington Post reporter Bob Woodward interviews a senior presidential aide to talk about the explosive testimony of White House counsel John Dean (see April 6-20, 1973 and April 24, 1973). The aide says that Dean will implicate Richard Nixon in the Watergate cover-up. “I’m not sure” what Dean has, the aide says. “I’m not sure it is evidence.” The aide is visibly upset. “The president’s lawyer is going to say that the president is… well, a felon.” He asks Woodward to leave. (Bernstein and Woodward 1974, pp. 308)
White House press secretary Ron Ziegler publicly apologizes to the Washington Post and two of its reporters, Carl Bernstein and Bob Woodward, for his earlier criticism of their Watergate reporting. In a report by UPI, Ziegler says that “mistakes were made” and that sometimes he was “overenthusiastic about his comments about the Post, particularly if you look at them in the context of developments that have taken place.” He adds, “When we are wrong, we are wrong, as we were in that case.” When Woodward calls Ziegler to thank him for the apology, Ziegler says coolly, “We all have our jobs.” (Bernstein and Woodward 1974, pp. 311-312)
After FBI Director William Ruckelshaus announces that 13 government officials and four reporters had been illegally wiretapped by the FBI at the behest of the Nixon administration (see May 1969), Washington Post reporter Bob Woodward learns that Secretary of State Henry Kissinger had authorized at least “some” of the taps. Incredulous, Woodward phones Kissinger for his response. Kissinger blames then-White House chief of staff H. R. Haldeman for authorizing the taps. But Kissinger does not directly deny authorizing any wiretaps, and Woodward presses the point. Kissinger admits that he may have given the FBI some names of people suspected of leaking information to the press, and that the agency might have construed that as authorization to wiretap. Woodward tells Kissinger that two separate sources have named him as personally authorizing electronic surveillance, and Kissinger replies, “Almost never.” As Woodward continues to press, Kissinger becomes angry, accusing Woodward of subjecting him to “police interrogation.” Kissinger says that if his office issued the authorizations, then he is responsible. Kissinger then asks Woodward if the reporter intends to quote him. Woodward says yes, and Kissinger explodes, “I’m telling you what I said was for background!” They had made no such agreement, Woodward says; Kissinger accuses Woodward of trying to penalize him for being honest. “In five years in Washington,” Kissinger complains, “I’ve never been trapped into talking like this.” Woodward cannot imagine what kind of treatment Kissinger is used to receiving. After the conversation, Woodward learns that Kissinger is routinely allowed to put his remarks on so-called “retroactive background” by other reporters. The Post editors decide to hold off on writing about Kissinger; as a result, they are beaten to the punch by the New York Times, which reports that Kissinger had fingered his own aides as being responsible for the wiretaps. The Post will report the 17 wiretaps, and add that the Secret Service had forwarded information on the private life of a Democratic presidential candidate to the White House; information on 1972 vice-presidential candidate Thomas Eagleton arrived in Haldeman’s office before it was leaked to the press; and Haldeman ordered the FBI to investigate CBS reporter Daniel Schorr in early 1973. (Bernstein and Woodward 1974, pp. 313-316)
Washington Post reporter Bob Woodward writes a memo to his editor, Ben Bradlee, largely based on his meetings with his FBI background source, “Deep Throat” (FBI deputy director W. Mark Felt—see May 31, 2005). The memo is full of material that will soon come out in either Senate testimony or the media, but also contains some information that Woodward cannot sufficiently confirm to allow him to write a news report. One of the most explosive items Woodward writes is the line, “Dean talked with Senator Baker after Watergate committee formed and Baker is in the bag completely, reporting back directly to White House.” If this is true, then according to former White House counsel John Dean, now cooperating with the Senate investigation, then the ranking Republican senator on the committee, Howard Baker (R-TN), is a White House “mole,” providing information directly to the White House about the committee’s deliberations, discussions, and future plans. The memo also reports that President Nixon personally threatened Dean and that another White House aide, Jack Caulfield, threatened Watergate burglar James McCord by saying “your life is no good in this country if you don’t cooperate” with the White House efforts to keep the Watergate conspiracy secret. The list of “covert national and international things” done by the Nixon re-election campaign were begun by campaign chief John Mitchell: “The list is longer than anyone could imagine.” According to Felt, “[t]he covert activities involve the whole US intelligence community and are incredible.” Felt refuses to give Woodward “specifics because it is against the law. The cover-up had little to do with the Watergate, but was mainly to protect the covert operations.” Felt has also told Woodward that Nixon himself is being blackmailed by one of the Watergate burglars, E. Howard Hunt (see June 20-21, 1972), at a total cost of around $1 million; the blackmail scheme involves just about every Watergate-connected figure in the White House. One reason the White House “cut loose” Mitchell was because Mitchell could not raise his portion of the money. Felt also told Woodward that senior CIA officials, including CIA director Richard Helms and deputy director Vernon Walters, are involved to some extent. Dean has explosive information that he is ready to reveal, but “plumber” G. Gordon Liddy is willing to go to jail or even die before revealing anything. Finally, rumors are running through the White House and the law enforcement and intelligence communities that Nixon is having “fits of ‘dangerous’ depression.” Some of this information will later be confirmed and reported, some of it will remain unconfirmed. (Bernstein and Woodward 1974, pp. 317-321; Spartacus Schoolnet 8/2007) Felt also warns Woodward that he, fellow Post reporter Carl Bernstein, and others at the newspaper may be under CIA surveillance and may even be in personal danger. The reporters confirm much of what Felt provided in a discussion with a Dean associate the next day. But both reporters and the Post editors worry that the new information might be part of an elaborate White House scheme to set up the reporters with false, discreditable information. In the following months, information elicted in the Senate committee hearings verifies everything Felt told Woodward, except the warning about being possibly wiretapped by the CIA. That is never verified. (Bernstein and Woodward 1974, pp. 317-321)
Washington Post reporter Bob Woodward learns of the White House’s plan to have “Plumber” E. Howard Hunt (see 2:30 a.m.June 17, 1972) break into the apartment of gunman Arthur Bremer immediately after Bremer shot presidential candidate George Wallace (see May 15, 1972). Hunt broke into Bremer’s apartment on the orders of White House aide Charles Colson, says a Senate Watergate Committee lawyer, a claim verified by Hunt’s lawyer, William Bittman. Woodward interviews Colson in the offices of his law firm, Colson & Shapiro; Colson, law partner David Shapiro, and attorney Judah Best not only deny that Colson ever ordered Hunt to do such a thing, but attempt to bribe Woodward with information about the “Canuck letter” (see February 24-25, 1972)—if Woodward will not print the story of Colson ordering Hunt to break into Bremer’s apartment, they will give him copies of two memos asserting that White House aide H. R. Haldeman tried to blame Colson for the authorship of the letter. Woodward refuses; the story runs. (Bernstein and Woodward 1974, pp. 329-330)
A gap of 18 and ½ minutes is found on the tape of a conversation between President Nixon and his aide, H. R. Haldeman, from June 20, 1972 (see July 13-16, 1973). Nixon lawyer Fred Buzhardt says he has no explanation for “the phenomenon.” Nixon’s secretary, Rose Mary Woods, denies any deliberate erasure. But electronics experts will eventually find that the tape has been deliberately erased at least five separate times. White House chief of staff Alexander Haig will blame “some sinister force” for the erasure.
Watergate Discussed - Former Watergate special prosecutor Archibald Cox’s subpoena of the tape (see July 23-26, 1973) says that “there is every reason to infer that the meeting included discussion of the Watergate incident.” That supposition is bolstered by previous testimony from former White House aide John Ehrlichman (see July 24, 1973). Watergate prosecutor Leon Jaworski says he is considering having all the remaining Watergate tapes placed under guard to prevent any further tampering. (Lardner 11/22/1973; Gerald R. Three Suspects - Evidence later shows that only three people could have made the erasure: Woods; Stephen Bull, Nixon’s assistant; and Nixon himself. (Reston 2007, pp. 33)
Washington Post Learns of Gap - Washington Post reporter Bob Woodward learned of “deliberate erasures” in the first week of November from his FBI source, W. Mark Felt (see May 31, 2005). White House sources confirmed that the tapes were often of poor quality, and that some inadvertent gaps existed, but, as press secretary Ron Ziegler tells Woodward’s colleague Carl Bernstein, to say that those gaps were deliberate would be “inaccurate.” When the deliberate gap is reported, Ziegler calls Bernstein to say that he did not know about the gap beforehand. Neither Bernstein nor Woodward doubt Ziegler—by this time, it is obvious that Nixon’s paranoia and penchant for secrecy extends even to the most trusted members of his staff. (Bernstein and Woodward 1974, pp. 333-334)
Symbolic - In 2005, Woodward will write: “The missing 18 1/2-minute gap soon becomes a symbol for Nixon’s entire Watergate problem. The truth had been deleted. The truth was missing.” (Woodward 2005, pp. 103)
The Washington Post reports that “Operation Candor,” the White House’s public relations campaign to clear President Nixon’s name regarding Watergate, has been shut down. It also reports that several of Nixon’s most senior advisers no longer believe his protestations of innocence and ignorance. White House chief of staff Alexander Haig calls the story “scurrilous.” Post reporters Carl Bernstein and Bob Woodward soon learn that Haig himself is dubious of Nixon’s course, and has urged Nixon to cut ties with three of his former aides, H. R. Haldeman, John Ehrlichman, and Charles Colson—to let them go down and ensure he doesn’t go with them. Nixon’s legal defense is constructed in concert with theirs, and the White House has been supplying their lawyers with the same documents it has been releasing to the special prosecutor’s office. Nixon himself has no intention of either accepting responsibility for his role in the Watergate conspiracy or making any public apology. “Contrition is bullsh_t,” press secretary Ron Ziegler has said, and that is an apparent reflection of Nixon’s own views. (Bernstein and Woodward 1974, pp. 334-335)
Washington Post reporters Carl Bernstein and Bob Woodward publish the book All the President’s Men, documenting their 26-month coverage of the Watergate scandal. The Post will win a Pulitzer Prize for its Watergate reporting and the book will be made into an Oscar-winning film of the same name. Between the book and the film, All the President’s Men will become the touchstone for defining the complex, multilayered Watergate conspiracy. (Slovik 1996)
FBI official R. E. Lewis writes an internal memo suggesting that the FBI disclose “some information from the Watergate investigation aimed at restoring to the FBI any prestige lost during that investigation. He argues, “Such information could also serve to dispel the false impression left by the book All the President’s Men (see June 15, 1974) that its authors, Carl Bernstein and Bob Woodward, not the FBI, solved the Watergate case.”
FBI Ahead of Reporters - “[A] comparison of the chronology of our investigation with the events cited in All the President’s Men will show we were substantially and constantly ahead of these Washington Post investigative reporters,” Lewis writes. “In essence, they were interviewing the same people we had interviewed but subsequent to our interviews and often after the interviewer had testified before the grand jury. The difference, which contributes greatly to the false image, is that the Washington Post blatantly published whatever they learned (or thought they learned) while we reported our findings to the US attorney and the Department [of Justice] solely for prosecutorial consideration.”
Decision Not to Go Public - The FBI will decide not to make any of its information public, citing ongoing prosecutions. In 2005, Woodward will counter: “What Long didn’t say—and what Felt [FBI deputy director Mark Felt, Woodward’s “Deep Throat”—see May 31, 2005] understood—was that the information wasn’t going anywhere until it was public. The US attorney and the Justice Department failed the FBI, as they folded too often to White House and other political pressure to contain the investigation and prosecution to the Watergate bugging (see 2:30 a.m.June 17, 1972). There was also a failure of imagination on the part of lots of experienced prosecutors, including US Attorney Earl Silbert, who could not initially bring himself to believe that the corruption ran to the top of the Justice Department and the White House. Only when an independent special prosecutor was appointed (see May 18, 1973) did the investigation eventually go to the broader sabotage and espionage matters. In other words, during 1972, the cover-up was working exceptionally well.” (Woodward 2005, pp. 120-121)
Former President Richard Nixon is nearly 20 minutes late for his second Watergate interview with David Frost (see April 13-15, 1977 and April 13, 1977). Neither Frost nor his team of researchers realize how rattled Nixon is from the last session. Frost begins the interview by asking about the so-called “Dean report” (see March 20, 1973), the results of John Dean’s “internal investigation” of the Watergate conspiracy. Dean’s report would have served two purposes: it would hopefully have removed suspicion from any White House officials as to their involvement in the conspiracy, and, if it was ever pulled apart and shown to be a compendium of lies and evasion, would have pointed to Dean as the central figure in the conspiracy. Dean never wrote the report, but instead became a witness for the prosecution (see April 6-20, 1973. June 3, 1973, and June 25-29, 1973). Since Dean never wrote the report, Frost asks Nixon why he told the deputy attorney general, Henry Peterson, that there was indeed such a report (Nixon had called it “accurate but not full”). Astonishingly, Nixon asserts that Dean did write the report, and that it indeed showed no “vulnerability or criminality on the part of the president… so let’s not get away from that fact.” Frost sees Nixon’s vulnerability. Frost asks when he read the report. Caught, Nixon backs off of his assertion, saying that he “just heard that ah… that he had written a report… ah… the… that… ah… he… ah… ah, considered it to be inadequate.” Frost researcher James Reston, Jr. later writes, “[Nixon] was firmly skewered. His face showed it. His gibberish confirmed it.”
Ehrlichman's Report - Frost moves on to another report on Watergate by former aide John Ehrlichman, the so-called “modified, limited hangout,” and the offer of $200,000 in cash to Ehrlichman and fellow aide H. R. Haldeman for their legal fees. Nixon had told the nation that Ehrlichman would produce an informative and factual report on Watergate, even though he knew by then that Ehrlichman was himself heavily involved in the conspiracy (see August 15, 1973). “That’s like asking Al Capone for an independent investigation of organized crime in Chicago,” Frost observes. “How could one of the prime suspects, even if he was the Pope, conduct an independent inquiry?” Instead of answering the question, Nixon ducks into obfuscation about what exactly constitutes a “prime suspect.”
Nixon Begins to Crack - Reston later writes that, looking back on the interview, it is at this point that Nixon begins to “crack” in earnest. Frost has cast serious doubts on Nixon’s veracity and used Nixon’s own words and actions to demonstrate his culpability. Now Frost asks a broader question: “I still don’t know why you didn’t pick up the phone and tell the cops. When you found out the things that Haldeman and Ehrlichman had done, there is no evidence anywhere of a rebuke, but only of scenarios and excuses.” Nixon responds with what Reston calls a long, “disjointed peroration… about Richard the Isolated and Richard the Victimized… Nixon was desperate to move from fact to sentiment.” But Nixon is not merely rambling. Woven throughout are mentions of the guilt of the various White House officials (but always others, never Nixon’s own guilt), apology, mistakes and misjudgments. Clearly he is hoping that he can paint himself as a sympathetic figure, victimized by fate, bad fortune, and the ill will of his enemies. (Haldeman is so outraged by this stretch that he will soon announce his intention to tell everything in a book—see February 1978; Ehrlichman will call it a “smarmy, maudlin rationalization that will be tested and found false.”) Nixon says he merely “screwed up terribly in what was a little thing [that] became a big thing.”
Crossroads - Frost tries to ease an admission of complicity from Nixon—perhaps if hammering him with facts won’t work, appealing to Nixon’s sentimentality will. “Why not go a little farther?” Frost asks. “That word mistake is a trigger word with people. Would you say to clear the air that, for whatever motives, however waylaid by emotion or whatever you were waylaid by, you were part of a cover-up?” Nixon refuses. Behind the cameras, Nixon staffer Jack Brennan holds up a legal pad with the message “LET’S TALK” (or perhaps “LET HIM TALK”—Reston’s memory is unclear on this point). Either way, Frost decides to take a short break. Brennan hustles Reston into a room, closes the door, and says, “You’ve brought him to the toughest moment of his life. He wants to be forthcoming, but you’ve got to give him a chance.” He wouldn’t confess to being part of a criminal conspiracy, and he wouldn’t admit to committing an impeachable offense. Nixon’s staff has been arguing for days that Nixon should admit to something, but Brennan and Reston cannot agree as to what. Reston later writes that Nixon is at a personal crossroads: “Could he admit his demonstrated guilt, express contrition, and apologize? Two years of national agony were reduced to the human moment. Could he conquer his pride and his conceit? Now we were into Greek theater.” When the interview resumes, Nixon briefly reminisces about his brother Arthur, who died from meningitis at age seven. Was Frost using the story of his brother to open Nixon up? “We’re at an extraordinary moment,” Frost says, and dramatically tosses his clipboard onto the coffee table separating the two men. “Would you do what the American people yearn to hear—not because they yearn to hear it, but just to tell all—to level? You’ve explained how you got caught up in this thing. You’ve explained your motives. I don’t want to quibble about any of that. Coming down to sheer substance, would you go further?” Nixon responds, “Well, what would you express?” Reston will later write, “Every American journalist I have ever known would shrivel at this plea for help, hiding with terror behind the pose of the uninvolved, ‘objective’ interviewer. The question was worthy of Socrates: Frost must lead Nixon to truth and enlightenment.” Frost gropes about a bit, then lists the categories of wrongdoing. First, there were more than mere mistakes. “There was wrongdoing, whether it was a crime or not. Yes, it may have been a crime, too. Two, the power of the presidency was abused. The oath of office was not fulfilled. And three, the American people were put through two years of agony, and… I think the American people need to hear it. I think that unless you say it, you’re going to be haunted for the rest of your life…”
Apology and Admission - Nixon’s response is typically long, prefaced with a rambling discussion of his instructions to speechwriter Ray Price to include his own name with those of Haldeman’s and Ehrlichman’s in the speech announcing their resignations “if you think I ought to” (see April 29, 1973), a litany of all the good things he did while president, and a short, bitter diatribe against those who had sought to bring him down. He never committed a crime, he insists, because he lacked the motive for the commission of a crime.
Terrible Mistakes - But all this is prelude. Nixon shifts to the core of the issue: he had made terrible mistakes not worthy of the presidency. He had violated his own standards of excellence. He deliberately misled the American people about Watergate, he admits, and now he regrets his actions. His statements were not true because they did not go as far as they should have, and “for all of those things I have a deep regret… I don’t go with the idea that what brought me down was a coup, a conspiracy. I gave ‘em the sword. They stuck it in and twisted it with relish. I guess if I’d been in their position, I’d’a done the same thing.” Nixon will not, or perhaps cannot, plainly admit that he broke the law in working to conceal the facts surrounding Watergate, but he does admit that after March 21, 1973, he failed to carry out his duties as president and went to “the edge of the law.… That I came to the edge, I would have to say that a reasonable person could call that a cover-up.” Reston notes that Nixon has just admitted to a standard of guilt high enough for a civil court if not a criminal court. But Nixon isn’t done. (Reston 2007, pp. 137-155)
Calls Resigning a 'Voluntary Impeachment' - “I did not commit, in my view, an impeachable offense,” he says. “Now, the House has ruled overwhelmingly that I did. Of course, that was only an indictment, and it would have to be tried in the Senate. I might have won, I might have lost. But even if I had won in the Senate by a vote or two, I would have been crippled. And in any event, for six months the country couldn’t afford having the president in the dock in the United States Senate. And there can never be an impeachment in the future in this country without a president voluntarily impeaching himself. I have impeached myself. That speaks for itself.” Resigning the presidency (see August 8, 1974), he says, was a “voluntary impeachment.” (Guardian 9/7/2007)
Reactions - Frost and his researchers are stunned at Nixon’s statements, as will the millions be who watch the interview when it is broadcast. (Reston 2007, pp. 137-155) In 2002, Frost will recall, “I sensed at that moment he was most the vulnerable he’d ever be, ever again. It seemed like an almost constitutional moment with his vulnerability at that point.… I hadn’t expected him to go as far as that, frankly. I thought he would have stonewalled more at the last stage. I think that was probably one of the reasons why it was something of a catharsis for the American people at that time that he had finally faced up to these issues, not in a court of law, which a lot of people would have loved to have seen him in a court of law, but that wasn’t going to happen. So—he’d been pardoned. But faced up in a forum where he was clearly not in control and I think that’s why it had the impact it did, probably.” (National Public Radio 6/17/2002) Not everyone is impressed with Nixon’s mea culpa; the Washington Post, for one, writes, “He went no further than he did in his resignation speech two and a half years ago,” in a story co-written by Watergate investigative reporter Bob Woodward. (Segal 4/30/2007) This interview will air on US television on May 26, 1977. (Steele 5/27/1977)
Former Nixon aide H. R. Haldeman, in his autobiography The Ends of Power, advances his own insider theory of the genesis of the Watergate burglaries (see July 26-27, 1970). Haldeman, currently serving a one-year prison sentence for perjuring himself during his testimony about the Watergate cover-up, became so angered while watching David Frost interview former President Nixon, and particularly Nixon’s attempts to pin the blame for Watergate on Haldeman and fellow aide John Ehrlichman (see April 15, 1977), that he decided to write the book to tell his version of events. Some of his assertions:
Nixon, Colson Behind 'Plumbers;' Watergate Burglary 'Deliberately Sabotaged' - He writes that he believes then-President Nixon ordered the operation that resulted in the burglaries and surveillance of the Democratic National Committee (DNC) headquarters because he and Charles Colson, the aide who supervised the so-called “Plumbers” (see Late June-July 1971), were both “infuriated with [DNC chairman Lawrence] O’Brien’s success in using the ITT case against them” (see February 22, 1972). Colson, whom Haldeman paints as Nixon’s “hit man” who was the guiding spirit behind the “Plumbers,” then recruited another White House aide, E. Howard Hunt, who brought in yet another aide, G. Gordon Liddy. Haldeman goes into a more interesting level of speculation: “I believe the Democratic high command knew the break-in was going to take place, and let it happen. They may even have planted the plainclothesman who arrested the burglars. I believe that the CIA monitored the Watergate burglars throughout. And that the overwhelming evidence leads to the conclusion that the break-in was deliberately sabotaged.” O’Brien calls Haldeman’s version of events “a crock.” As for Haldeman’s insinuations that the CIA might have been involved with the burglaries, former CIA director Richard Helms says, “The agency had nothing to do with the Watergate break-in.” Time magazine’s review of the book says that Haldeman is more believable when he moves from unverifiable speculation into provable fact. One such example is his delineation of the conspiracy to cover up the burglaries and the related actions and incidents. Haldeman writes that the cover-up was not a “conspiracy” in the legal sense, but was “organic,” growing “one step at a time” to limit political damage to the president.
Story of Kennedy Ordering Vietnamese Assassination Actually True - He suggests that the evidence Hunt falsified that tried to blame former president John F. Kennedy of having then-South Vietnamese President Ngo Dinh Diem assassination (see Mid-September 1971) may have pointed to the actual truth of that incident, hinting that Kennedy may have ordered the assassination after all.
US Headed Off Two Potentially Catastrophic Nuclear Incidents with USSR, China - He also writes of a previously unsuspected incident where Nixon and other US officials convinced the Soviets not to attack Chinese nuclear sites. And Haldeman tells of a September 1970 incident where the US managed to head off a second Cuban Missile Crisis. Both stories of US intervention with the Soviets are strongly denied by both of Nixon’s Secretaries of State, Henry Kissinger, and William Rogers.
Duality of Nixon's Nature - Haldeman says that while Nixon carried “greatness in him,” and showed strong “intelligence, analytical ability, judgment, shrewdness, courage, decisiveness and strength,” he was plagued by equally powerful flaws. Haldeman writes that Nixon had a “dirty, mean, base side” and “a terrible temper,” and describes him as “coldly calculating, devious, craftily manipulative… the weirdest man ever to live in the White House.” For himself, Haldeman claims to have always tried to give “active encouragement” to the “good” side of Nixon and treat the “bad” side with “benign neglect.” He often ignored Nixon’s “petty, vindictive” orders, such as giving mass lie detector tests to employees of the State Department as a means of finding security leaks. He writes that while he regrets not challenging Nixon more “frontally” to counter the president’s darker impulses, he notes that other Nixon aides who had done so quickly lost influence in the Oval Office. Colson, on the other hand, rose to a high level of influence by appealing to Nixon’s darker nature. Between the two, Haldeman writes, the criminal conspiracy of Watergate was created. (Colson disputes Haldeman’s depiction of his character as well as the events of the conspiracy.) Haldeman himself never intended to do anything illegal, denies any knowledge of the “Gemstone” conspiracy proposal (see January 29, 1972), and denies ordering his aide Gordon Strachan to destroy evidence (see June 18-19, 1972).
Reconstructing the 18 1/2 Minute Gap - Haldeman also reconstructs the conversation between himself and Nixon that was erased from the White House tapes (see June 23, 1972 and July 13-16, 1973). Time notes that Haldeman reconstructs the conversation seemingly to legally camouflage his own actions and knowledge, “possibly to preclude further legal charges against him…” According to Haldeman’s reconstruction, Nixon said, “I know one thing. I can’t stand an FBI interrogation of Colson… Colson can talk about the president, if he cracks. You know I was on Colson’s tail for months to nail Larry O’Brien on the [Howard] Hughes deal (see April 30 - May 1, 1973; O’Brien had worked for Hughes, and Nixon was sure O’Brien had been involved in illegalities). Colson told me he was going to get the information I wanted one way or the other. And that was O’Brien’s office they were bugging, wasn’t it? And who’s behind it? Colson’s boy Hunt. Christ. Colson called [deputy campaign chief Jeb Magruder] and got the whole operation started. Right from the g_ddamn White House… I just hope the FBI doesn’t check the office log and put it together with that Hunt and Liddy meeting in Colson’s office.” Time writes, “If the quotes are accurate, Nixon is not only divulging his own culpability in initiating the bugging but is also expressing a clear intent to keep the FBI from learning about it. Thus the seeds of an obstruction of justice have been planted even before the celebrated June 23 ‘smoking gun’ conversation, which ultimately triggered Nixon’s resignation from office.” Haldeman says he isn’t sure who erased the tape, but he believes it was Nixon himself. Nixon intended to erase all the damning evidence from the recordings, but since he was, Haldeman writes, “the least dexterous man I have ever known,” he quickly realized that “it would take him ten years” to erase everything.
'Smoking Gun' Allegations - Haldeman also makes what Time calls “spectacular… but unverified” allegations concerning the June 23, 1972 “smoking gun” conversations (see June 23, 1972). The focus of that day’s discussion was how the White House could persuade the CIA to head off the FBI’s investigation of the Watergate burglary. The tape proved that Nixon had indeed attempted to block the criminal investigation into Watergate, and feared that the money found on the burglars would be traced back to his own re-election campaign committee. Haldeman writes that he was confused when Nixon told him to tell the CIA, “Look, the problem is that this will open up the whole Bay of Pigs thing again.” When Haldeman asked Helms to intercede with the FBI, and passed along Nixon’s warning that “the Bay of Pigs may be blown,” Helms’s reaction, Haldeman writes, was electric. “Turmoil in the room, Helms gripping the arms of his chair, leaning forward and shouting, ‘The Bay of Pigs had nothing to do with this. I have no concern about the Bay of Pigs.’” Haldeman writes, “I was absolutely shocked by Helms‘[s] violent reaction. Again I wondered, what was such dynamite in the Bay of Pigs story?” Haldeman comes to believe that the term “Bay of Pigs” was a reference to the CIA’s secret attempts to assassinate Cuban dictator Fidel Castro. The CIA had withheld this info from the Warren Commission, the body that investigated the assassination of President Kennedy, and Haldeman implies that Nixon was using the “Bay of Pigs thing” as some sort of blackmail threat over the CIA. Haldeman also hints, very vaguely, that Nixon, when he was vice president under Dwight D. Eisenhower, was a chief instigator of the actual Bay of Pigs invasion. (Time notes that while Vice President Nixon probably knew about the plans, “he certainly had not been their author.”)
Other Tidbits - Haldeman writes that Nixon’s taping system was created to ensure that anyone who misrepresented what Nixon and others said in the Oval Office could be proven wrong, and that Nixon had Kissinger particularly in mind. Nixon kept the tapes because at first he didn’t believe he could be forced to give them up, and later thought he could use them to discredit former White House counsel John Dean. He says Nixon was wrong in asserting that he ordered Haldeman to get rid of the tapes. Haldeman believes the notorious “deep background” source for Washington Post reporters Carl Bernstein and Bob Woodward was actually Fred Fielding, Dean’s White House deputy. Interestingly, Haldeman apparently discovered the real identity of “Deep Throat” in 1972 to be senior FBI official W. Mark Felt (see October 19, 1972). It is unclear why Haldeman now writes that Fielding, not Felt, was the Post source.
Not a Reliable Source - Time notes that Haldeman’s book is far from being a reliable source of information, characterizing it as “badly flawed, frustratingly vague and curiously defensive,” and notes that “[m]any key sections were promptly denied; others are clearly erroneous.” Time concludes, “Despite the claim that his aim was finally to ‘tell the truth’ about the scandal, his book is too self-protective for that.” And it is clear that Haldeman, though he writes how the cover-up was “morally and legally the wrong thing to do—so it should have failed,” has little problem being part of such a criminal conspiracy. The biggest problem with Watergate was not that it was illegal, he writes, but that it was handled badly. He writes, “There is absolutely no doubt in my mind today that if I were back at the starting point, faced with the decision of whether to join up, even knowing what the ultimate outcome would be, I would unhesitatingly do it.” (Time 2/27/1978; Spartacus Schoolnet 8/2007)
Former FBI Deputy Director W. Mark Felt, who served before and during the Watergate era, denounces the attempts by the Nixon administration to control the FBI and the Justice Department. Felt, who unbeknownst to the public was Washington Post reporter Bob Woodward’s celebrated inside source nicknamed “Deep Throat” (see May 31, 2005), writes scathingly in his memoir The FBI Pyramid of what he calls the “White House-Justice Department cabal” that worked to conceal the Watergate conspiracy. He does not reveal himself to be Woodward’s source. (Woodward 2005, pp. 33)
Former White House counsel John Dean, who served prison time for his complicity in the Watergate conspiracy (see September 3, 1974), receives an early morning phone call from CBS reporter Mike Wallace. Dean has tried to keep a low public profile for over a decade, focusing on his career in mergers and acquisitions and staying out of politics. Wallace wants Dean’s reaction to a not-yet-published book by Leonard Colodny and Robert Gettlin, Silent Coup, which advances a very different theory about the Watergate affair than is generally accepted. According to Dean’s own writing and a Columbia Journalism Review article about the book, the book’s allegations are as follows:
Richard Nixon was guilty of nothing except being a dupe. Instead, Dean is the mastermind behind the Watergate conspiracy. Dean became involved both to find embarrassing sexual information on the Democrats and to protect his girlfriend, Maureen “Mo” Biner (later his wife), who is supposedly listed in a notebook linked to a prostitution ring operating out of the Watergate Hotel. This alleged prostitution ring was, the authors assert, patronized or even operated by officials of the Democratic Party. Dean never told Nixon about the prostitution ring, instead concocting an elaborate skein of lies to fool the president. According to the authors, Dean’s wife Maureen knew all about the call girl ring through her then-roommate, Heidi Rikan, whom the authors claim was actually a “madame” named Cathy Dieter. The address book belonged to a lawyer involved in the prostitution ring, Philip Macklin Bailey.
According to the book, the other schemer involved in Watergate was Nixon’s chief of staff Alexander Haig. Haig wanted to conceal his role as part of a military network spying on Nixon and his national security adviser, Henry Kissinger (see December 1971). Haig orchestrated the titular “silent coup” to engineer Nixon’s removal from office.
Haig was the notorious “Deep Throat,” the inside source for Washington Post reporter Bob Woodward (see May 31, 2005). Far from being a crusading young reporter, Woodward is, the book alleges, a “sleazy journalist” trying to cover up his background in military intelligence. Woodward had a strong, if covert, working relationship with Haig. (Weinberg 11/1991; Dean 2006, pp. xv-xvii)
During the phone call, Wallace tells Dean, “According to Silent Coup, you, sir, John Dean, are the real mastermind of the Watergate break-ins, and you ordered these break-ins because you were apparently seeking sexual dirt on the Democrats, which you learned about from your then girlfriend, now wife, Maureen.” Wallace says that the book alleges that Dean had a secretive relationship with E. Howard Hunt, one of the planners of the Watergate burglary. Dean replies that he had little contact with Hunt during their White House careers, and calls the entire set of allegations “pure bullsh_t.” He continues: “Mike, I’m astounded. This sounds like a sick joke.” Wallace says that the authors and publisher, St. Martin’s Press, claim Dean was interviewed for the book, but Dean says no one has approached him about anything related to this book until this phone call. Dean says he is willing to refute the book’s claims on Wallace’s 60 Minutes, but wants to read it first. CBS cannot give Dean a copy of the book due to a confidentiality agreement. (Dean 2006, pp. xv-xvii) Dean will succeed in convincing Time’s publishers not to risk a lawsuit by excerpting the book (see May 7, 1991), and will learn that the book was co-authored behind the scenes by Watergate burglar and conservative gadfly G. Gordon Liddy (see May 9, 1991 and After). The book will be published weeks later, where it will briefly make the New York Times bestseller list (see May 1991) and garner largely negative reviews (see June 1991).
The authors of the upcoming book Silent Coup, Leonard Colodny and Robert Gettlin, are interviewed on CBS’s Good Morning America. The book alleges that former White House counsel John Dean masterminded the Watergate burglary (see 2:30 a.m.June 17, 1972) to prove that Democrats were operating a prostitution ring, and that Dean’s wife Maureen had inside knowledge of the prostitution ring (see May 6, 1991). Dean has already convinced CBS’s flagship news program, 60 Minutes, not to air a segment on the book, and convinced Time magazine not to excerpt the book in its upcoming issue (see May 7, 1991). Dean says the book is false to the point of libel (see May 6, 1991). Dean has informed the Good Morning America producers of his intention to sue both the authors and the publisher of the book. Reflecting on the affair in his 2006 book Conservatives Without Conscience, Dean writes: “[W]e had mortally wounded the book and destroyed the carefully planned launch, which might had given the story credibility. Now it would be difficult to treat Silent Coup as legitimate news.” Dean recalls being less than impressed with the authors as they discuss their book with Good Morning America’s anchor, Charles Gibson. Colodny, whom Dean will describe as “a retired liquor salesman and conspiracy buff,” and Gettlin, “a journalist,” appear “tense.” Gibson does not believe their story, Dean observes. Gibson skims past the material concerning Dean and his wife, and focuses on the equally specious allegations about Washington Post reporter Bob Woodward (supposedly a CIA agent) and then-White House chief of staff Alexander Haig (who supposedly planned the “coup” of the title that forced Richard Nixon out of office). (Dean 2006, pp. xix-xx)
Silent Coup authors Leonard Colodny and Robert Gettlin (see May 6, 1991 and May 6, 1991) appear on CNN’s Larry King Live. Defending themselves from charges by former White House counsel John Dean that they have libeled him and his wife Maureen (see May 7, 1991), the authors deny any allegations against Maureen Dean even though their book claims that she is the key to understanding the entire Watergate conspiracy. Halfway through the show, Dean will write, the authors “disappear… without explanation, as if snatched from their seats by hooks.” They are replaced by Washington Post reporter Howard Kurtz and convicted Watergate burglar G. Gordon Liddy. Liddy falsely claims that John Dean and others named in the book, particularly Post reporter Bob Woodward and former White House chief of staff Alexander Haig, refused to appear on 60 Minutes to refute the charges by Colodny and Gettlin. Liddy also lies about Time magazine’s decision not to excerpt the book, saying that the book is “so densely packed that it did not lend itself to being excerpted, and they felt that they couldn’t do it.” In reality, Dean, Woodward, and Haig had all agreed to appear on 60 Minutes to refute the book; CBS pulled the segment because the authors could not prove any of their sensational claims about prostitution rings and CIA manipulations. Time chose not to print the excerpt after Dean alerted them that he was filing lawsuits against the authors and the publisher, St. Martin’s Press. 60 Minutes reporter Mike Wallace, who would have anchored the segment, calls King to refute Liddy’s misrepresentations. Wallace says: “We objected to the fact that the authors refused or declined to let the objects of their scrutiny, these three in particular, see the book, read the book ahead of time, so that they could face the charges.… We could not, on our own, source the thing sufficiently to satisfy ourselves that it stood up as a 60 Minutes piece. That’s why we didn’t do the piece.” Watching the interview, Maureen Dean applauds as Wallace destroys the book’s credibility on the air. (Dean 2006, pp. xx-xxi)
Former White House counsel John Dean helps destroy the credibility of the sensationalistic new book Silent Coup, which alleges that Dean masterminded the Watergate burglary (see 2:30 a.m.June 17, 1972), that his wife was involved in a Democratic Party-operated prostitution ring (see May 6, 1991), that Washington Post reporter Bob Woodward, one of the reporters instrumental in exposing the Watergate conspiracy, was a CIA plant, and former White House chief of staff Alexander Haig orchestrated the “silent coup” that removed Richard Nixon from office (see May 8, 1991). Dean learns that convicted Watergate burglar G. Gordon Liddy (see January 30, 1973) worked behind the scenes with the book’s authors, Leonard Colodny and Robert Gettlin, on developing, sourcing, and writing the book. Although Dean has played a key role in destroying the book’s credibility, the publisher, St. Martin’s Press, intends on publishing the book anyway, now marketing it to what Dean will later call “Nixon apologists and right-wingers, giving them a new history of Nixon’s downfall in which Bob Woodward, Al Haig, and John Dean were the villains, and randy Democrats had all but invited surveillance. Who better to peddle this tale than uber-conservative Gordon Liddy?” Preparing for an onslaught of negative publicity and legal actions, St. Martin’s Press doubles its defamation insurance and reissues Liddy’s Watergate biography, Will, with a new postscript that endorses Silent Coup. Dean notes that for years, Liddy has attempted to restore Nixon’s tarnished reputation at the expense of others, particularly Dean and Liddy’s fellow burglar, E. Howard Hunt. The book comes at a perfect time for Liddy, Dean will later note: “Since the first publication of Will in 1980 he had made a living by putting his dysfunctional personality on display. By the early nineties speaking engagements were becoming less frequent for him, and his business ventures, including several novels, were unsuccessful. Silent Coup put him back in the spotlight, where he loved to be—publicly misbehaving.” Dean is disturbed when another convicted Watergate figure, former White House counsel Charles Colson, joins Liddy in backing the book. Dean believed that he and Colson had forged a friendship during their incarceration in federal prison (see September 3, 1974), and questions Colson’s integrity and his public reinvention as a Christian minister because of Colson’s endorsement. (Dean 2006, pp. xx-xxii)
Silent Coup, an alternate theory of the Watergate conspiracy by Leonard Colodny and Robert Gettlin (see May 6, 1991), is published. It quickly makes the New York Times bestseller list. (Dean 2006, pp. xxiv) The same day it is published, the Washington Post runs an article by media reporter Howard Kurtz that thoroughly discredits the book. Kurtz notes that both CBS and Time magazine chose not to feature the book because the authors refused to provide any proof of their allegations (see May 7, 1991); two of the authors’ primary sources of information, former Joint Chiefs of Staff chairman Thomas Moorer and former Pentagon spokesman Jerry Friedheim, both disavow statements they are said to have made; and the primary Watergate figures, Post reporter Bob Woodward, former White House aide Alexander Haig, and former White House counsel John Dean, harshly repudiate the book’s contentions. (Weinberg 11/1991)
The Columbia Journalism Review gives a decidedly mixed review to the recently published book, Silent Coup, by Leonard Colodny and Robert Gettlin (see May 6, 1991). Reviewer Steve Weinberg notes that the book “mixes superb and shoddy research, sound reasoning with logical inconsistencies, clear writing with incomprehensible passages.” The book lacks verifiable sourcing. Thus, Weinberg notes, the book “cannot be dismissed out of hand, but it cannot stand on its own.” Weinberg details the competing claims for the book:
Some Watergate figures, most notably convicted burglar G. Gordon Liddy, support the book. (Weinberg observes that the book contradicts many of the claims advanced in Liddy’s Watergate biography, Will. Weinberg is apparently unaware that Liddy secretly co-authored the book—see May 9, 1991 and After.) In contrast, Washington Post reporter Bob Woodward, cited as a shady intelligence asset in the book, calls it “untrue and pathetic.” Woodward’s partner in the Watergate investigations, Carl Bernstein, dismisses the book as a “lunatic” piece of work. Former White House chief of staff Alexander Haig, accused in the book of fomenting the coup that forced Richard Nixon out of the presidency, calls the book “a scandalous fabrication.” Former White House counsel John Dean, named the “mastermind” of the Watergate conspiracy, calls the book “absolute garbage” (see May 6, 1991).
The book was discredited by the Washington Post the day it was published (see May 1991) and again five weeks later (see June 1991). Eminent historian Stephen Ambrose dismissed the book out of hand in a New York Times review. But other, equally reputable reviewers and media outlets such as the Los Angeles Times and the more ideologically conservative National Review praised the book. (Weinberg 11/1991) The Post called it one of “the most boring conspiracy books ever written” despite its “wild charges and vilifications,” and the Times observed the book showed “a stunning ignorance of how the government under Mr. Nixon operated.” Samuel Dash, the chief counsel for the Senate Watergate Committee, called the book “a fraud… contradicted by everything on the White House tapes and by the evidence.” (Lardner 7/23/1997)
Some time after he is appointed CIA Director (see July 11, 1997), but before 9/11, George Tenet negotiates a series of agreements with telecommunications and financial institutions “to get access to certain telephone, Internet, and financial records related to ‘black’ intelligence operations.” The arrangements are made personally by the companies’ CEOs and Tenet, who plays “the patriot card” to get the information. The arrangement involves the CIA’s National Resources Division, which has at least a dozen offices in the US. The Division’s main aim is to recruit people in the US to spy abroad. However, in this case the Division makes arrangements so that other intelligence agencies, such as the NSA, can access the information and records the CEOs agree to provide. (Woodward 2006, pp. 323-5) There is a history of co-operation between the CIA’s National Resources Division and the NSA. For example, Monte Overacre, a CIA officer assigned to the Division’s San Diego office in the early 1990s, said that he worked with the NSA there, obtaining information about foreign telecommunications programs and passing it on to the Technology Management Office, a joint venture between the two agencies. (Dreyfuss 1/1998) One US official will say that the arrangements only give the CIA access to the companies’ passive databanks. However, reporter Bob Woodward will say that the programme raises “serious civil liberties questions and also demonstrate[d] that the laws had not kept pace with the technology.” (Woodward 2006, pp. 324-5) There will be an interagency argument about the program after 9/11 (see (2003 and After)).
On September 4 and 5, 2001, FBI agent Robert Fuller attempts to find hijackers Nawaf Alhazmi and Khalid Almihdhar in the US. However, he fails to perform many basic checks, including a check of credit card usage (see September 4-5, 2001). In 2006, journalist Bob Woodward will report that CIA Director George Tenet believed that FBI could have potentially stopped the 9/11 attacks. Woodward will write, paraphrasing Tenet, “If the FBI had done a simple credit card check on the two 9/11 hijackers who had been identified in the United States before 9/11, Nawaf Alhazmi and Khalid Almihdhar, they would have found that the two men had bought 10 tickets for early morning flights for groups of other Middle Eastern men for September 11, 2001. That was knowledge that might conceivably have stopped the attacks.” (Woodward 2006, pp. 79-80) Alhazmi and Almihdhar did buy some tickets for themselves and Nawaf Alhazmi also bought a ticket for his brother Salem Alhazmi, but it has not been reported that they bought as many as ten tickets (see August 25-27, 2001 and August 25-September 5, 2001).
A short pre-recorded statement is broadcast on television, in which President Bush tells the nation that all appropriate security measures are being taken, and he assures people that “the United States will hunt down and punish those responsible for these cowardly acts.” (CNN 9/12/2001; Sammon 2002, pp. 117) The 219-word statement, lasting two minutes, was recorded about half an hour ago in a conference room at Barksdale Air Force Base, Louisiana (see 12:36 p.m. September 11, 2001). (Keen and Carney 9/11/2001; Woodward 2002, pp. 19)
Bush Says US Will Find and Punish Terrorists - Bush begins: “Freedom itself was attacked this morning by faceless cowards. And freedom will be defended.” He continues: “Make no mistake: The United States will hunt down and punish those responsible for these cowardly acts.” He reassures the public that he has been in contact with his colleagues in Washington, DC, and they “have taken all appropriate security precautions to protect the American people. Our military at home and around the world is on high alert status, and we have taken the necessary security precautions to continue the functions of your government.” He says, “[W]e will do whatever is necessary to protect America and Americans.” He concludes his statement, saying: “The resolve of our great nation is being tested. But make no mistake: We will show the world that we will pass this test. God bless.” (CNN 9/11/2001; White House 9/11/2001)
Bush Remains at Base after Speech Is Broadcast - After the president’s statement was recorded, Rich Del Haya, a military public relations officer at Barksdale, brought the videotape of it to a TV satellite truck outside the base. A technician there put the tape into a deck to be broadcast. However, the uplink failed twice. Finally, the third broadcast goes out to American TV screens. TV anchors emphasize that the president’s remarks are recorded, not live. “The implication,” journalist and author Bill Sammon will later write, “was that the White House had purposely delayed the airing of the tape in order to get a head start on the president’s next secret destination.” (Sammon 2002, pp. 117; Villafuerte 9/8/2002) The 9/11 Commission Report will similarly state that “for security reasons,” Bush’s statement “was taped and not broadcast live.” (9/11 Commission 7/24/2004, pp. 325) But according to Sammon: “[T]he tape delay had been a function of mere logistics—there were no cables available at Barksdale for a live feed on such short notice. In fact, Bush remained at Barksdale more than half an hour after his taped speech was aired.” (Sammon 2002, pp. 117)
Bush's Delivery of Statement Is 'Not Reassuring' - Some commentators will later be critical of Bush’s performance in delivering his statement. Washington Post reporter Bob Woodward will write: “The president’s eyes were red-rimmed when he walked in. His performance was not reassuring. He spoke haltingly, mispronouncing several words as he looked down at his notes.” (Woodward 2002, pp. 19) Howard Fineman of Newsweek will call the speech “the low point” in the president’s war on terrorism. (Sammon 2002, pp. 116) Bush will comment that the “sentiment” of his speech “was right, but the setting—a sterile conference room at a military base in Louisiana—did not inspire much confidence.” (Bush 2010, pp. 133)
After a meeting with the full National Security Council from 9:00 to 10:00 p.m. (see (9:00 p.m.-10:00 p.m.) September 11, 2001), President Bush continues meeting with a smaller group of advisers. During this meeting, Bush says the US will punish not just the perpetrators of the 9/11 attacks, but also those who harbored them (this closely echoes the rhetoric he used in a speech that evening (see 8:30 p.m. September 11, 2001)). Secretary of State Colin Powell suggests the US needs to build a coalition of other nations. But according to the 9/11 Commission, Defense Secretary Donald Rumsfeld urges Bush to “think broadly about who might have harbored the attackers, including Iraq, Afghanistan, Libya, Sudan, and Iran. He wonder[s] aloud how much evidence the United States would need in order to deal with these countries, pointing out that major strikes could take up to 60 days to assemble.” (9/11 Commission 7/24/2004, pp. 330) According to journalist Bob Woodward, at this meeting, “Rumsfeld actually puts Iraq on the table and says, ‘Part of our response maybe should be attacking Iraq. It’s an opportunity.’” (Kirk 6/20/2006) Earlier in the day, notes by a Rumsfeld aide indicate Rumsfeld was aware that evidence was already suggesting al-Qaeda was behind the 9/11 attacks, but he wanted to use 9/11 as an excuse to attack Iraq as well (see (2:40 p.m.) September 11, 2001).
After concluding a National Security Council meeting (see September 12, 2001), President Bush continues meeting with about six top principal cabinet members. Defense Secretary Donald Rumsfeld poses the question, “Do we focus on bin Laden and al-Qaeda or terrorism more broadly?” Secretary of State Colin Powell suggests the US should focus on terrorism generally, but focus first on al-Qaeda. Vice President Cheney brings up the issue of state sponsorship. “To the extent we define our task broadly, including those who support terrorism, then we get at states. And it’s easier to find them than it is to find bin Laden.” President Bush concludes, “Start with bin Laden, which Americans expect. And then if we succeed, we’ve struck a huge blow and can move forward.” He called the terrorism threat “a cancer” and adds, “We don’t want to define [it] too broadly for the average man to understand.” This is according to journalist Bob Woodward, who later interviews some participants in the meeting. (Woodward 2002, pp. 43) The main alleged state sponsor that interests many top Bush officials is Iraq. For instance, five days later Bush will state he believes Iraq was involved in the 9/11 attacks, but that an attack on Iraq will have to wait (see September 17, 2001).
During a National Security Council meeting, FBI Director Robert Mueller begins to describe the investigation under way to identify the 9/11 hijackers. According to journalist Bob Woodward, “He said it was essential not to taint any evidence so that if accomplices were arrested, they could be convicted.” But Attorney General John Ashcroft interrupts. Woodward will paraphrase Ashcroft saying, “The chief mission of US law enforcement… is to stop another attack and apprehend any accomplices or terrorists before they hit us again. If we can’t bring them to trial, so be it.” Woodward will comment, “Now, Ashcroft was saying, the focus of the FBI and the Justice Department should change from prosecution to prevention, a radical shift in priorities.” President Bush is at the meeting and apparently does not challenge Ashcroft’s suggestion. (Woodward 2002, pp. 42-43)
President Bush and Prince Bandar, the Saudi ambassador to the US, hold a private meeting at the White House. Vice President Cheney, National Security Adviser Rice, and Bandar’s aide Rihab Massoud also attend. (Woodward 2006, pp. 80) Bandar is so close to the Bush family that he is nicknamed “Bandar Bush.” Senator Bob Graham (D-FL) later will note that while little is known about what is discussed in the meeting, mere hours later, the first flights transporting Saudi royals and members of the bin Laden family are in the air (see September 13, 2001). Over the next week, they will be taken to several gathering points, and then flown back to Saudi Arabia, apparently without first being properly interviewed by the FBI (see September 14-19, 2001). Graham will say, “Richard Clarke, then the White House’s counterterrorism tsar, told me that he was approached by someone in the White House seeking approval for the departures. He did not remember who made the request… The remaining question is where in the White House the request originated, and how.” Graham will imply that, ultimately, the request originated from this meeting between Bush and Bandar. (Graham and Nussbaum 2004, pp. 105-107) Others also will later suggest that it was Bandar who pushed for and helped arrange the flights. (Unger 10/2003; Baer 10/29/2003 ) Bob Woodward will mention in a 2006 book that during the meeting, Bush tells Bandar, “If we [capture] somebody and we can’t get them to cooperate, we’ll hand them over to you.” Woodward will later comment, “With these words, the president casually expressed what became the US government’s rendition policy-the shifting of terrorist suspects from country to country for interrogation.… Though the Saudis denied it, the CIA believe the Saudis tortured terrorist suspects to make them talk.” (Woodward 2006, pp. 80)
The issue of possible Iraqi involvement in the 9/11 attacks is debated in a National Security Council meeting. According to journalist Bob Woodward, President Bush ends the debate by saying, “I believe Iraq was involved, but I’m not going to strike them now. I don’t have the evidence at this point.” Bush says wants to keep working on plans for military action in Iraq but indicates there will be plenty of time to do that later. Right now his focus is mainly on Afghanistan. (Woodward 2002, pp. 99) At the time Bush says this, no evidence has emerged possibly linking Iraq to 9/11. One day later, an account of hijacker Mohamed Atta meeting an Iraqi agent in Prague will become known, but it will ultimately be discredited (see September 18, 2001).
During a National Security Council meeting attended by CIA Director Tenet, National Security Adviser Rice, Secretary of State Powell, Vice President Cheney and others, President Bush says of the 9/11 attacks, “Many believe Saddam [Hussein] is involved. That’s not an issue for now. If we catch him being involved, we’ll act. He probably was behind this in the end.” He also says, “What we do in Afghanistan is an important part of our effort. It’s important to be serious and that’ll be a signal to other countries about how serious we are on terror.” He mentions Syria and Iran as countries he wants to warn. This is according to journalist Bob Woodward, who interviews many top officials at the meeting. (Woodward 2002, pp. 167) One week earlier, the CIA advised Bush that there was no link between al-Qaeda and the Iraqi government. CIA Director Tenet also told Bush that the one alleged connection between Iraq and the 9/11 attack “just doesn’t add up” (see September 21, 2001).
Vice President Cheney chairs a National Security Council meeting because President Bush is overseas. According to journalist Bob Woodward, who later interviews many participants in the meeting, the topic of the recent anthrax attacks is discussed (see October 5-November 21, 2001). CIA Director George Tenet suggests that al-Qaeda is behind the attacks. He also adds, “I think there’s a state sponsor involved. It’s too well thought out, the powder’s too well refined. It might be Iraq, it might be Russia, it might be a renegade scientist,” perhaps from Iraq or Russia. Vice President Cheney’s chief of staff I. Lewis Libby also suggests the anthrax attacks were state sponsored. “We’ve got to be careful on what we say. If we say it’s al-Qaeda, a state sponsor may feel safe and then hit us thinking they will have a bye because we’ll blame it on al-Qaeda.” Tenet replies, “I’m not going to talk about a state sponsor.” Vice President Cheney comments, “It’s good that we don’t, because we’re not ready to do anything about it.” (Woodward 2002, pp. 244) No strong evidence will emerge tying the attacks to al-Qaeda or any state sponsor. The anthrax attacks still remain completely unsolved.
President Bush makes it very clear how he feels about North Korean leader Kim Jong Il. According to Bob Woodward’s book Bush at War, Bush shouts at Woodward: “I loathe Kim Jong Il!… I’ve got a visceral reaction to this guy, because he is starving his people. And I have seen intelligence of these [North Korean] prison camps—they’re huge—that he uses to break up families, and to torture people.” Bush says he will not change his opinion of Kim “until he proves to the world that he has a good heart.” (Scoblic 2008, pp. 232-233)
In a speech to the Nashville convention of the Veterans of Foreign Wars, Vice President Dick Cheney says Saddam Hussein will “seek domination of the entire Middle East, take control of a great portion of the world’s energy supplies, directly threaten America’s friends throughout the region, and subject the United States or any other nation to nuclear blackmail.” He also states unequivocally that Iraq has weapons of mass destruction. “Simply stated, there is no doubt that Saddam Hussein now has weapons of mass destruction. There is no doubt that he is amassing them to use against our friends, against our allies, and against us.… What he wants is time, and more time to husband his resources to invest in his ongoing chemical and biological weapons program, and to gain possession of nuclear weapons.… Deliverable weapons of mass destruction in the hands of a terror network, or a murderous dictator, or the two working together constitutes as grave a threat as can be imagined,” he says. “The risks of inaction are far greater than the risk of action.… The Iraqi regime has in fact been very busy enhancing its capabilities in the field of chemical and biological agents, and they continue to pursue the nuclear program they began so many years ago.” Therefore he argues, the answer is not weapons inspections. “Against that background, a person would be right to question any suggestion that we should just get inspectors back into Iraq, and then our worries will be over. Saddam has perfected the game of shoot and retreat, and is very skilled in the art of denial and deception. A return of inspectors would provide no assurance whatsoever of his compliance with UN resolutions.” He also says: “Regime change in Iraq would bring about a number of benefits to the region. When the gravest of threats are eliminated, the freedom-loving peoples of the region will have a chance to promote the values that can bring lasting peace.” (Cheney 8/26/2002)
First White House Assertion of Iraq's Nuclear Program - Cheney’s speech marks the first major statement from the White House regarding the Bush administration’s Iraq policy following a flood of criticisms from former officials. Significantly, the speech was not cleared by the CIA or the State Department. (Fineman and Lipper 9/9/2002) Furthermore, Cheney’s comments dismissing the need for the return of inspectors, were not cleared by President Bush, according to White House chief of staff Andrew Card. (Fineman and Lipper 9/9/2002) The speech creates a media stir because it is the first time a senior US official has asserted Iraq has nuclear capabilities with such certainty. The CIA is astonished by the claim. CIA official Jami Miscik will later recall: “He said that Saddam was building his nuclear program. Our reaction was, ‘Where is he getting that stuff from? Does he have a source of information that we don’t know about?’” CIA analysts redouble their efforts to collect and review evidence on Iraq and nuclear weapons, but analysts know very little. (Suskind 2006, pp. 167-169) Cheney’s assertions are contradicted by a broad base of military experts. (Dean 2004, pp. 138)
Powell 'Blindsided' by Cheney - Three days after the speech, a State Department source tells CNN that Secretary of State Colin Powell’s view clashes with that which was presented in Cheney’s speech, explaining that the secretary of state is opposed to any military action in which the US would “go it alone… as if it doesn’t give a damn” what other nations think. The source also says that Powell and “others in the State Department were ‘blindsided’ by Cheney’s ‘time is running out’ speech… and were just as surprised as everyone else.” (Koppel 8/30/2002) Author and Washington Post reporter Bob Woodward will later describe Powell as “dumbfounded.” (Roberts 2008, pp. 145) Cheney did, however, inform President Bush he would be speaking to the VFW. He did not provide Bush a copy of his speech. Bush merely told Cheney, “Don’t get me into trouble.” (Dubose and Bernstein 2006, pp. 175)
'Off Script' - Current deputy press secretary Scott McClellan will later observe that it was always a tactic of the Iraq campaign strategy for Cheney to “lean a little more forward in his rhetoric than the president.” However, McClellan will go on to say that Cheney did not always “stay on message,” and will blame Cheney’s “deep-seated certitude, even arrogance” that sometimes operates “to the detriment of the president.” Cheney’s assertion to the VFW that it would be pointless to send UN inspectors back to Iraq is, McClellan will reflect, “off script.” Bush wants to continue to “show that he [is] exhausting all diplomatic options” before invading Iraq. (McClellan 2008, pp. 138)
During a meeting at Camp David held with most principal cabinet members but without President Bush, Vice President Cheney argues against asking for a new UN resolution authorizing force against Iraq. Secretary of State Colin Powell argues in favor of getting a new UN resolution. Journalist Bob Woodward, who later has access to some of the participants in the meeting, will comment, “Cheney was beyond hell-bent for action against Saddam. It was as if nothing else existed.” (Woodward 2002, pp. 245-346)
Author and famed reporter Bob Woodward’s book Bush at War is published.
Unprecedented Access - Woodward, who made his reputation uncovering the Watergate conspiracy from 30 years before (see June 15, 1974), is no longer an unknown young reporter working to find sources that will confide in him. Now he is an established Washington insider. For this book, Woodward was granted “unprecedented access” to Bush administration officials, including notes from National Security Council meetings and two long interviews with President Bush himself, far more access than even that granted to the 9/11 Commission and Congressional inquiries into other events of interest. Former Republican House Speaker Newt Gingrich will find this level of access inexplicable, saying that “it makes no sense for an administration that has jealously guarded its executive privilege to allow a reporter the access it denies to members of Congress.”
Hagiographic Account - The Observer’s Peter Preston calls Woodward’s book a “more-or-less instant study of the White House after 9/11,” and writes that while Woodward could have created “a classic of investigative journalism,” instead he gave us a compendium of “painful, obsessively useless detail” that generally paints the picture the White House wants painted. If Woodward’s book is to be believed, Preston writes, the Colin Powell moderates and the Dick Cheney hawks “had their snappy moments, but they’re OK-ish now.” CIA Director George Tenet “is a far-sighted man” who not only immediately divined that Osama bin Laden was behind the attacks, but while the towers were still burning, wondered if the attacks had anything to do with “that guy taking pilot training,” Zacarias Moussaoui. Iraq war planner General Tommy Franks usually feels “finer than the hair on a frog’s back.” Former President Clinton’s “weak-willed men used to ‘pound the desert’ ineffectually, while his brilliant successors like to hit something, if at all possible.” And President Bush “is bright and talented and eloquent and decisive,” who runs National Security Council meetings himself and knows all he needs to know about the state of the world (Woodward quotes Bush as saying, “I’m not a textbook player—I’m a gut player”). Both Preston and author Frank Rich accuse Woodward of “burnishing” Bush’s image at the expense of the truth. A few potentially embarrassing tidbits manage to poke their way through what both Preston and Rich call the “hagiography,” mostly relating to senior administration officials’ lack of knowledge about Afghan tribal politics and the lack of evidence tying Saddam Hussein to the 9/11 attacks. But all told, the book seems to tell a clear story: where Clinton was indecisive, Bush is forthright; where Clinton muddled around with bin Laden and Middle East terrorism, Bush is taking the war straight into the heart of the Islamist redoubt. (Preston 12/1/2002; Rich 2006, pp. 66-67) The book gives such a favorable impression of Bush and his administration that the Republican National Committee will recommend it on its Web site. (Foer 11/12/2006)
Selective Reporting - The administration officials who talked to Woodward are painted in largely glowing terms, while those who did not (including Attorney General John Ashcroft and Homeland Security head Tom Ridge) are, in Preston’s words, “written out of the script.” Potentially embarrassing incidents such as the administration’s complete failure to find the source of the anthrax mailings of 2001 (see September 17-18, 2001 and October 5-November 21, 2001) and the ineffective roundup of thousands of Middle Eastern “terror suspects” after 9/11 (see Late November, 2001) are ignored entirely. The pivotal Afghan battle of Tora Bora, where bin Laden was allowed to escape US clutches (see Mid-November 2001-Mid-December 2001), gets two paragraphs. (Preston 12/1/2002; Rich 2006, pp. 66-67) Guardian reviewer Peter Symon notes that Woodward even fails to ask the most “obvious questions” about the 9/11 attacks, instead accepting the administration’s accounts of events and its responses as absolute and unquestionable. (Symon 1/29/2003) Rich notes that Woodward grants Bush and his officials tremendous individual credence, taking their word on one issue after another without question: for example, when Bush calls investigative journalist Seymour Hersh “a liar,” Woodward takes Bush’s word without giving Hersh a chance to respond. More generally, Woodward never asks the obvious follow-up questions. Bush explains why the US didn’t attack Afghanistan and Iraq simultaneously after the 9/11 attacks: “If we tried to do too many things… militarily, then… the lack of focus would have been a huge risk.” Rich notes, “The follow-up question that was not to be found in Bush at War was simple enough: If it was a huge risk to split our focus between Saddam and al-Qaeda then, why wasn’t it now?” Preston concludes: “Maybe the Woodward of three decades ago would have given [the Bush administration more intense scrutiny]. No longer. Today’s Woodward, eight bestsellers later, skates breathlessly from interview to interview and notepad to notepad without ever, seemingly, stopping to think, ‘Why am I being told all this? What does it mean?’ It isn’t investigation, just cross-referenced compilation.” (Preston 12/1/2002; Rich 2006, pp. 66-67)
The Guardian reports on the state of journalism in the US: “The worldwide turmoil caused by President Bush’s policies goes not exactly unreported, but entirely de-emphasized. Guardian writers are inundated by e-mails from Americans asking plaintively why their own papers never print what is in these columns… If there is a Watergate scandal lurking in [the Bush] administration, it is unlikely to be Washington Post journalist Bob Woodward or his colleagues who will tell us about it. If it emerges, it will probably come out on the web. That is a devastating indictment of the state of American newspapers.” (Engel 1/13/2003)
By mid-March 2003, Washington Post journalist Walter Pincus is skeptical of Colin Powell’s speech to the UN (see February 5, 2003) and develops material for an article questioning Powell’s evidence. However, his editors are not interested.
Page A17 - But thanks to pressure from his colleague Bob Woodward, the Post runs his story on March 16, but only on page A17. The article reads, “US intelligence agencies have been unable to give Congress or the Pentagon specific information about the amounts of banned weapons or where they are hidden….” It notes that senior US officials “repeatedly have failed to mention the considerable amount of documented weapons destruction that took place in Iraq between 1991 and 1998.” (Massing 2/26/2004) Washington Post Executive Editor Leonard Downie Jr. will later say, “In retrospect, that probably should have been on Page 1 instead of A17, even though it wasn’t a definitive story and had to rely on unnamed sources. It was a very prescient story.” (Kurtz 8/12/2004)
Follow-up - Two days later, the Post publishes another critical story by Pincus, this one co-written with Dana Milbank. It reads, “As the Bush administration prepares to attack Iraq this week, it is doing so on the basis of a number of allegations against Iraqi President Saddam Hussein that have been challenged—and in some cases disproved—by the United Nations, European governments and even US intelligence reports.” However, this story only appears on page A13. (Massing 2/26/2004)
Third Story Held Until After Start of War - Around the same time, Post journalists Dana Priest and Karen DeYoung turn in a story that says CIA officials “communicated significant doubts to the administration” about evidence tying Iraq to attempted uranium purchases for nuclear weapons. But the story is held until March 22, three days after the Iraq war begins. (Kurtz 8/12/2004)
Post's Editors Did Not Want to "Make a Difference" - Pincus will later comment, “The front pages of The New York Times, The Washington Post, and the Los Angeles Times are very important in shaping what other people think. They’re like writing a memo to the White House.” But the Post’s editors “went through a whole phase in which they didn’t put things on the front page that would make a difference.” (Massing 2/26/2004) Downie will later say, “Not enough of those stories were put on the front page. That was a mistake on my part.” (Kurtz 8/12/2004)
Lewis Libby, the chief of staff for Vice President Dick Cheney, provides classified information to author and reporter Bob Woodward for use in his upcoming book Plan of Attack, which will document the Bush administration’s push for war with Iraq. According to his own later testimony (see March 24, 2004), Libby is authorized to disclose this information to Woodward by President Bush. The information is from the October 2002 National Intelligence Estimate, which documented the purported WMD belonging to Iraq (see October 1, 2002). In 2006, other former senior officials in the Bush administration will add that Bush told others to cooperate with Woodward as well. One official will say: “There were people on the seventh floor [of the CIA] who were told by [CIA Director George] Tenet to cooperate because the president wanted it done. There were calls to people to by [White House communications director] Dan Bartlett that the president wanted it done, if you were not cooperating. And sometimes the president himself told people that they should cooperate.” It is unclear whether any other White House official provides Woodward with classified information. (Waas 4/6/2006) It is unclear whether Libby discloses this information to Woodward during two June 2003 meetings he has with the reporter (see June 23, 2003 and June 27, 2003), or at another, unreported meeting.
After the morning publication of a Washington Post article by reporter Walter Pincus questioning the validity of the Iraq WMD claims (see June 12, 2003), members of the National Security Council, along with White House and State Department staffers, discuss the story. Among the information exchanged is the knowledge that the wife of former ambassador Joseph Wilson, whose trip to Niger helped spark the Post article’s questions about Iraqi WMD (see February 21, 2002-March 4, 2002), is a CIA official. “After Pincus,” a former intelligence later officer says, “there was general discussion with the National Security Council and the White House and State Department and others” about Wilson’s trip and its origins. According to a report by Time magazine, neither Secretary of State Colin Powell nor his deputy, Richard Armitage, speak to anyone at the White House about Wilson’s trip or Plame Wilson’s identity until after July 6, but this claim, sourced by someone “familiar with the [Wilson] memo” (see March 8, 2002), is false; Armitage will inform Post reporter Bob Woodward about Plame Wilson’s identity the day after the Pincus article (see June 13, 2003). Deputy CIA Director John McLaughlin will later say that the White House asks about the Wilson trip around this time, but cannot remember when that information was requested (see May 29, 2003, June 2003, June 9, 2003, June 9, 2003, 4:30 p.m. June 10, 2003, 5:25 p.m. June 10, 2003, 12:00 p.m. June 11, 2003, and 5:27 p.m. June 11, 2003). McLaughlin will say that “we looked into it and found the facts of it, and passed it on.” (Novak 7/31/2005)
Washington Post reporter Bob Woodward meets with Deputy Secretary of State Richard Armitage, who informs him that Valerie Plame Wilson is a CIA officer working on the issue of WMD in the Middle East. Plame Wilson is the wife of Joseph Wilson, who was sent to Niger to determine the truth behind the Iraq-Niger uranium claims (see February 21, 2002-March 4, 2002 and July 6, 2003). (Woodward 11/16/2005; Shenon 8/23/2006; MSNBC 2/21/2007) Armitage has just received the information from State Department intelligence officers, who forwarded him a memo marked “Secret” that included information about Wilson’s trip, his findings, and the fact that his wife is a CIA agent (see June 10, 2003). (Hamburger and Efron 8/25/2005)
Revealing Plame Wilson's Identity - Woodward asks Armitage why the CIA would send Wilson to Niger. “It was Joe Wilson who was sent by the agency,” Woodward says, according to an audiotape Woodward plays for the court during the Lewis Libby trial (see February 12, 2007). “I mean, that’s just—” Armitage answers, “His wife works in the agency.” The two then have the following exchange:
Woodward: “Why doesn’t that come out? Why does—”
Armitage: “Everyone knows it.” (It is unclear who or what Armitage is referring to. Columnist Byron York will later write that Armitage is referring to Wilson being the anonymous foreign ambassador criticizing Bush in the press.)
Woodward: “That have to be a big secret? Everyone knows.”
Armitage: “Yeah. And I know [expletive deleted] Joe Wilson’s been calling everybody. He’s pissed off because he was designated as a low-level guy, went out to look at it. So, he’s all pissed off.”
Woodward: “But why would they send him?”
Armitage: “Because his wife’s a [expletive deleted] analyst at the agency.”
Woodward: “It’s still weird.”
Armitage: “It’s perfect. This is what she does—she is a WMD analyst out there.”
Woodward: “Oh, she is.”
Woodward: “Oh, I see.”
Armitage: “[Expletive deleted] look at it.”
Woodward: “Oh, I see. I didn’t [expletive deleted].”
Armitage: “Yeah, see?”
Woodward: “Oh, she’s the chief WMD?” (asking if Plame Wilson is the head of the Iraqi WMD bureau within the agency—see April 2001 and After).
Armitage: “No, she isn’t the chief, no.”
Woodward: “But high enough up that she can say, ‘Oh yeah, hubby will go?” (see February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005).
Armitage: “Yeah, he knows Africa.”
Woodward: “Was she out there with him?”
Woodward: “When he was an ambassador?”
Armitage: “Not to my knowledge. I don’t know. I don’t know if she was out there or not. But his wife is in the agency and is a WMD analyst. How about that [expletive deleted]?” (New York Sun 6/13/2003; Apuzzo 2/12/2007; York 2/13/2007)
Woodward Does Not Report Plame Wilson's Identity - Woodward does not report this information. But Armitage’s divulgence may be the first time an administration official outs Plame Wilson, an undercover CIA agent, to a journalist. Woodward will later call the disclosure “casual and offhand,” and say the disclosure “did not appear to me to be either classified or sensitive.” He will note that “an analyst in the CIA is not normally an undercover position.” Woodward tells fellow Post reporter Walter Pincus that Plame Wilson is a CIA agent, but Pincus will say he does not recall the conversation. Woodward will note that on June 20, he will interview a “second administration official” with a notation to ask about “Joe Wilson’s wife,” but according to the recording of their conversation, the subject never comes up. Woodward enjoys extraordinary access to the White House for preparation of his second book on the Bush administration, Plan of Attack. (Woodward 11/16/2005; Shenon 8/23/2006; Unger 2007, pp. 310; MSNBC 2/21/2007)
Washington Post reporter Bob Woodward interviews White House chief of staff Andrew Card for his new book, Plan of Attack. Woodward has a list of prepared questions that include the topic of “Joe Wilson’s wife,” meaning CIA official Valerie Plame Wilson, but, as Woodward will later testify (see November 14, 2005), he never broaches the subject of Wilson’s wife. “It did not come up,” Woodward will later say, but he will admit that it is possible he did ask about Plame Wilson. He will testify that the subject of Nigerien yellowcake uranium, in regards to the specious Iraq-Niger uranium allegations, does come up in their conversation. He will deny ever speaking to Lewis Libby about the subject of Plame Wilson. (Woodward 11/16/2005; Marcy Wheeler 2/12/2007) Woodward is aware of Plame Wilson’s identity as a CIA official (see June 13, 2003).
Washington Post reporter Bob Woodward has a telephone conversation with Vice President Cheney’s chief of staff, Lewis “Scooter” Libby. Woodward informs Libby that he is sending an 18-page list of questions for his upcoming book, Plan of Attack, that he wants to ask Cheney. One question is about “yellowcake” uranium, obviously a reference to the claims that Iraq had tried to purchase uranium from Niger (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003), and another is about the National Intelligence Estimate on Iraq (see October 1, 2002). Woodward will later testify that he does not discuss Valerie Plame Wilson, the covert CIA agent whom another government official had “outed” to him a few days before (see June 13, 2003). Washington Post reporter Bob Woodward speaks with Lewis Libby, Vice President Dick Cheney’s chief of staff, in preparation for an interview he intends to conduct with Cheney for his book Plan of Attack. Woodward sends a list of questions to Libby for Cheney, including a question about “yellowcake” uranium and the October 2002 National Intelligence Estimate regarding Iraq’s weapons programs (see October 1, 2002). He will later testify that he does not include a question about CIA official Valerie Plame Wilson in the list of questions, though he did consider asking White House chief of staff Andrew Card about her (see June 20, 2003). (Woodward 11/16/2005; Marcy Wheeler 2/12/2007) Woodward is aware of Plame Wilson’s identity as a CIA official (see June 13, 2003).
Washington Post reporter Bob Woodward meets with Vice President Dick Cheney’s chief of staff, Lewis “Scooter” Libby, pursuant to their telephone conversation four days prior (see June 23, 2003). Woodward’s interview is in regards to to his upcoming book Plan of Attack. Although Woodward questions Libby about the prewar National Intelligence Estimate on Iraq (see October 1, 2002) and the Iraq-Niger uranium claims (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003), Woodward will later testify that the subject of “outed” CIA agent Valerie Plame Wilson does not come up. He will say that he may have asked Libby about either Plame Wilson or her husband Joseph Wilson (see February 21, 2002-March 4, 2002 and July 6, 2003), but he has nothing in his notes about Libby discussing the subject. (Woodward 11/16/2005; Marcy Wheeler 2/12/2007) Woodward is aware of Plame Wilson’s identity as a CIA official (see June 13, 2003). According to later testimony from Woodward (see November 14, 2005), Libby discusses classified information from the October 2002 NIE (see October 1, 2002) that purports to show Iraq attempted to buy enriched uranium from Africa. According to Woodward’s notes, Libby describes the purported Iraqi efforts to buy uranium as “vigorous.” (Gellman and Linzer 4/9/2006)
Syndicated columnist Robert Novak, a well-established Washington conservative, lands an interview with Deputy Secretary of State Richard Armitage. Novak has been trying for some time to schedule an interview with Armitage without success, but Armitage calls him virtually out of nowhere and offers an interview. They agree to meet soon after the 4th of July holiday. It is at this meeting that Armitage will tell Novak that administration critic Joseph Wilson’s wife is a covert CIA agent (see July 8, 2003), just as he has previously told Washington Post reporter Bob Woodward (see June 13, 2003). (Unger 2007, pp. 310)
Showtime broadcasts a “docudrama” about the 9/11 attacks and the White House’s response, entitled DC 9/11: Time of Crisis. According to New York Times author and media critic Frank Rich, the film drastically rewrites history to portray President Bush as “an unironic action-movie superhero.” In the movie, Bush—portrayed by actor Timothy Bottoms, who played Bush in Comedy Central’s satiric That’s My Bush!—is shown overruling his Secret Service detail and ordering Air Force One to return to Washington immediately, an event which never happened (see (10:32 a.m.) September 11, 2001 and (4:00 p.m.) September 11, 2001). “If some tinhorn terrorist wants me, tell him to come and get me!” the movie Bush shouts. “I’ll be at home, waiting for the b_stard!” The movie Bush has other lines that establish his desire to get back to Washington, including, “The American people want to know where their damn president is!” and “People can’t have an AWOL president!” In one scene, a Secret Service agent questions Bush’s demand to return to Washington by saying, “But Mr. President—” only to be cut off by Bush, who snaps, “Try ‘Commander in Chief.’ Whose present command is: Take the president home!” In reality, most of the orders on 9/11 were given by Vice President Dick Cheney and counterterrorism “tsar” Richard Clarke, but in the movie, Bush is the man in charge. “Hike military alert status to Delta,” he orders Defense Secretary Donald Rumsfeld. “That’s the military, the CIA, foreign, domestic, everything,” he explains. “And if you haven’t gone to Defcon 3, you oughtta.” To Cheney, he barks: “Vice? We are at war.” The White House team are, in Rich’s words, “portrayed as the very model of efficiency and derring-do.” (Farhi 6/19/2003; Stanley 9/5/2003; Rich 2006, pp. 25-26) New York Times reviewer Alessandra Stanley notes that Bush is the unquestioned hero of the film, with British Prime Minister Tony Blair portrayed as “not very eloquent” and Cheney depicted as “a kowtowing yes-man.” (Stanley 9/5/2003)
Conservative Pundits Influenced Script - The movie is produced by Lionel Chetwynd, whom Rich calls “the go-to conservative in B-list Hollywood.” For the movie script, Chetwynd was given unprecedently broad access to top White House officials, including Bush. He also received the assistance of conservative Washington pundits Charles Krauthammer, Morton Kondracke, and Fred Barnes, who cover the Bush White House for such media outlets as Fox News, the Weekly Standard, and the Washington Post. Rich later writes that much of the film seems based on Bob Woodward’s “hagiographic [book] Bush at War (see November 25, 2002).” (Farhi 6/19/2003; Rich 2006, pp. 25-26)
Propaganda Effort? - Before the movie airs, Toronto Sun columnist Linda McQuaig called the film an attempt to mythologize Bush in a fashion similar to Hollywood’s re-creation of the Wild West’s Wyatt Earp, and wrote that the film “is sure to help the White House further its two-pronged reelection strategy: Keep Americans terrified of terrorism and make Bush look like the guy best able to defend them.” Texas radio commentator Jim Hightower added that the movie would present Bush as “a combination of Harrison Ford and Arnold Schwarzenegger.… Instead of the doe-eyed, uncertain, worried figure that he was that day, Bush-on-film is transformed into an infallible, John Wayne-ish, Patton-type leader, barking orders to the Secret Service and demanding that the pilots return him immediately to the White House.” Chetwynd himself has acknowledged that he is a “great admirer” of Bush, and has close ties to the White House. In late 2001, Bush appointed him to the President’s Committee on the Arts and the Humanities. “This isn’t propaganda,” Chetwynd insisted during the shooting of the movie, adding: “Everything in the movie is [based on] two or three sources. I’m not reinventing the wheel here.… I don’t think it’s possible to do a revision of this particular bit of history. Every scholar who has looked at this has come to the same place that this film does. There’s nothing here that Bob Woodward would disagree with.… It’s a straightforward docudrama. I would hope what’s presented is a fully colored and nuanced picture of a human being in a difficult situation.” (Farhi 6/19/2003) Rich will later write that the film is “unmistakably a propaganda effort on behalf of a sitting administration.” (Rich 2006, pp. 25-26)
Blaming the Clinton Administration - Perhaps most questionably, Stanley writes, the film “rarely misses a chance to suggest that the Clinton administration’s weakness was to blame for the disaster.” Bush, she notes, is portrayed as a more decisive leader than his predecessor: in the film, he tells Blair over the telephone: “I want to inflict pain [on the attackers]. Bring enough damage so they understand there is a new team here, a fundamental change in our policy.” (Stanley 9/5/2003)
9/11 Widow Unhappy with Film - Kristen Breitweiser, who lost her husband in the attack on the World Trade Center, calls the film “a mind-numbingly boring, revisionist, two-hour-long wish list of how 9/11 might have gone if we had real leaders in the current administration.” She adds: “It is understandable that so little time is actually devoted to the president’s true actions on the morning of 9/11. Because to show the entire 23 minutes from 9:03 to 9:25 a.m., when President Bush, in reality, remained seated and listening to ‘second grade story-hour’ while people like my husband were burning alive inside the World Trade Center towers, would run counter to Karl Rove’s art direction and grand vision.” Breitweiser questions numerous aspects of the film: “Miscellaneous things that surprised me included the fact that the film perpetuates the big fat lie that Air Force One was a target. Forgive me, but I thought the White House admitted at the end of September 2001 that Air Force One was never a target, that no code words were spoken and that it was all a lie (see (10:32 a.m.) September 11, 2001 and September 12, 2001-March 2004). So what gives?… Not surprisingly, there is no mention of accountability. Not once does anyone say, ‘How the hell did this happen? Heads will roll!’ I was hoping that, at least behind closed doors, there were words like, ‘Look, we really screwed up! Let’s make sure we find out what went wrong and that it never happens again!’ Nope, no such luck.” (Breitweiser 9/8/2003)
In his monthly newsletter, conservative pundit Rush Limbaugh says that American liberals and Democrats are attacking President Bush for his Christian faith. “So now what does the left attack the president for?” he writes. “His belief in God!… Well, I’m going to predict something. If enough voters hear [Washington Post reporter] Bob Woodward berate Bush for relying on God, get ready for it.… Let them impugn the president of the United States for his admitting that he prays for the safety of the troops and the American people, let them make fun of that. They’re going to pay the price.” Limbaugh offers no evidence that nationally recognized liberals, Democratic Party members, or prominent reporters such as Woodward have criticized Bush for his Christian beliefs. (Jamieson and Cappella 2008, pp. 101)
Deputy Secretary of State Richard Armitage testifies for a second time before the grand jury investigating the Plame Wilson identity leak. Armitage has testified to the grand jury before, but information on that testimony will be redacted from publicly available court documents. Armitage was interviewed by FBI agents almost a year before today’s grand jury appearance (see October 1, 2003 and October 2, 2003). In today’s appearance, Armitage denies discussing Valerie Plame Wilson with any reporter other than columnist Robert Novak (see July 14, 2003 and September 14, 2004). (US District Court for the District of Columbia 9/27/2004 ) Armitage is lying; he informed Washington Post reporter Bob Woodward of Plame Wilson’s identity in June 2003 (see June 13, 2003).
Columnist and media observer Allan Wolper notes that while conservative columnist Robert Novak, who outed CIA agent Valerie Plame Wilson apparently at the behest of the White House (see July 14, 2003), continues to “spout… off in his syndicated column, he keeps a secret he would not permit any politician to get away with.” Wolper is writing of Novak’s continued refusal to divulge whether he was subpoenaed by the grand jury investigating the case, or if he testified before that grand jury. Wolper calls it an “untenable ethical position,” and bolsters his position with observations from media ethicists such as Robert Steele, the director of ethics for the Poynter Institute of Media Studies. “If he has a justifiable reason to withhold that information, he should give a reason why,” Steele says. “Otherwise, he is undermining his credibility as an honest broker of ethical journalism. If he were on the other side, he would challenge journalists for not saying anything.” Novak is defended by, among others, Washington Post reporter and assistant managing editor Bob Woodward, who says: “Bob Novak has taken a stand that is supported by many in the press. He is protecting his sources. He has done nothing that is illegal or improper.” (Wolper is unaware as of this writing that Woodward has his own secondary involvement in the case, having been himself told of Plame Wilson’s identity several times before (see June 13, 2003, June 23, 2003, and June 27, 2003).) Wolper notes that while Novak has refused to speak about subpoenas or testimonies, Post reporters Glenn Kessler and Walter Pincus have both given sworn depositions to the grand jury (see June 22, 2004 and September 15, 2004). Wolper writes, “They might have been able to fight off their subpoenas if their lawyers had known whether Novak… had been called by the grand jury.” Aside from Kessler and Pincus, Time reporter Matthew Cooper (see July 17, 2003) testified after being threatened with jail (see May 21, 2004, August 24, 2004, July 6, 2005, and July 13, 2005), and New York Times reporter Judith Miller is facing jail rather than testify (see December 2004). “Novak has an obligation to own up,” Wolper writes. Instead, “Novak continues to live a charmed life in journalism, writing his column and appearing regularly on CNN, where he is never challenged.” CNN media critic Jeff Greenfield says of Novak’s case, “I haven’t thought it through. I don’t want to talk about it, because I have no opinion on it.” Jack Nelson, the retired bureau chief of the Los Angeles Times, says: “This whole thing is really strange. Novak was the guy who wrote the column that exposed the CIA agent, and yet they don’t seem to be going after him.” (Wolper 12/1/2004)
An extremist arrested and interrogated in Saudi Arabia appears to disclose details of an operation that is strikingly similar to the 7/7 London bombings that will occur in mid-2005 (see July 7, 2005). However, the intelligence does not yield any results before the attacks, even though it is shared with the US and Britain. It will later be unclear whether the arrested man, known as Adel, provided a truthful account or was a fabricator who just happened to predict some details of the plot. Adel is arrested in Buraydah, Saudi Arabia, in late 2004 for using a fraudulent passport, and a memo on his interrogation dated December 14 of that year, which is sent to the CIA and British intelligence, seems to reveal details of a multifaceted operation. Some details match those of the actual attack: it is to be carried out by four people in London in the middle of 2005, some of them British citizens, and will include a location around “Edgewood Road” (one of the bombs will explode at Edgeware Road tube station). The target is said to be a subway station or a nightclub. However, Adel, who is said to know Abu Musab al-Zarqawi, also says the explosives will come from Bosnia and the plot will be coordinated by a Libyan businessman in London, who will help with safe houses and transport. In addition, one of the bombers is said to have tattoos on his fingers. The Saudis send Britain and the US a second report in February 2005, providing more details about the alleged bombers, who are supposed to be from different countries, although there are also apparently Caucasian British and Germans involved. The CIA checks a Syrian phone number mentioned in one of the memos, but finds nothing. (Woodward 2006, pp. 400-2; Barnett 2/5/2006) After the bombings, Saudi ambassador to London Prince Turki will say in a statement, “There was certainly close liaison between the Saudi Arabian intelligence authorities and the British intelligence authorities some months ago, when information was passed to Britain about a heightened terrorist threat to London,” although it is unclear whether this statement refers to this warning, another Saudi warning about a possible attack in Britain (see April 2005 or Shortly Before), or both. (Bright 11/1/2007) Interest in the detainee will be revived after the attack and even President Bush will become involved, but veteran reporter Bob Woodward, who examines the story in a 2006 book, will conclude that Adel is a fabricator. (Woodward 2006, pp. 400-2) However, a Saudi security adviser will later say that he is “convinced” the information passed on was “directly linked” to the 7/7 bombings. (Barnett 2/5/2006)
