White House chief counsel Alberto Gonzales discusses firing some or all of the 93 US Attorneys with Kyle Sampson, a Justice Department counsel for Attorney General John Ashcroft (see 2001-2003). White House emails do not definitively show that White House political chief Karl Rove is behind the push to fire the Attorneys, though they do indicate Rove has some involvement. According to a January 2005 email from Sampson (see January 9, 2005), Sampson discusses the matter with Gonzales in late December, and, the email states, “As an operational matter we would like to replace 15-20 percent of the current US Attorneys—underperforming ones.” It is clear that Sampson is referring to himself and Gonzales as “we.” (Gonzales will later deny any recollection of any such discussion with Sampson.) The White House will later say that the idea of firing all 93 US Attorneys originated with White House counsel Harriet Miers and not Rove (see November 2004). White House spokesperson Dana Perino will say: “Karl Rove has a recollection of hearing it from Harriet and thinking it was a bad idea. There is nothing in this email that changes that.… [It] does not contradict nor is it inconsistent with what we have said.” Miers will not begin her stint as White House counsel until February 2005, calling Perino’s version of events into question, even though Perino will later say that Miers was involved in issues surrounding the job for several months before officially assuming the post. (Ragavan 3/16/2007; Kiel 3/16/2007; Thomas 2011) In March 2007, the Justice Department’s Director of Public Affairs Tasia Scolinos will issue a statement claiming that Gonzales “has no recollection of any plan or discussion” to replace the US Attorneys when he was still White House counsel. Scolinos will note that the December 2004 discussion took place while Gonzales was preparing to transition to the Justice Department as attorney general, and will add that such discussions would have been “appropriate and normal” because the White House was “considering different personnel changes administration-wide.” (Ragavan 3/16/2007)
A memo from the nonpartisan Congressional Research Service (CRS) finds that President Bush appears to be in violation of the National Security Act of 1947 in his practice of briefing only select members of Congress on the National Security Agency’s warrantless wiretapping program. Bush has provided only limited briefings to the so-called “Gang of Eight,” the four Congressional leaders and the four ranking members of the House and Senate Intelligence Committees. But the 1947 law requires the US intelligence community to brief the full membership of both committees on the program. The memo is the result of a request by Representative Jane Harman (D-CA), who wrote Bush a letter saying that she believes he is required under the Act to brief both committees, and not just the Gang of Eight (see January 4, 2006). The White House claims that it has briefed Congressional leaders about the program over a dozen times, but refuses to provide details; the Congressional members so briefed are forbidden by law to discuss the content or nature of those classified briefings, even with their own staff members. “We believe that Congress was appropriately briefed,” says White House spokeswoman Dana Perino. The CRS agrees with Harman that the single exception to such full briefings under the law, covert actions taken under extraordinary threats to national security, is not applicable in this instance. Unless the White House contends the program is a covert action, the memo says, “limiting congressional notification of the NSA program to the Gang of Eight…would appear to be inconsistent with the law.” (US House of Representatives 1/4/2006; Congressional Research Service 1/18/2006 ; Eggen 1/19/2006) The day after the CRS memo is released, Senate Democrats John D. Rockefeller (D-WV) and Harry Reid (D-NV), along with House Minority Leader Nancy Pelosi (D-CA) and Harman, the ranking member of the House Intelligence Committee, write to Vice President Dick Cheney demanding that the full committees be briefed on such intelligence matters in the future. (Leonnig 1/20/2006) On February 9, Bush will allow Attorney General Alberto Gonzales and former NSA chief Michael Hayden to brief the full House Intelligence Committee on the program (see February 8-17, 2006).
USA Today reports that “[t]he National Security Agency (NSA) has been secretly collecting the phone call records of tens of millions of Americans, using data provided by the nation’s three biggest telecommunications providers, AT&T, Verizon, and BellSouth,” according to “people with direct knowledge of the arrangement.” None of the sources would allow USA Today to identify them by name, job, or affiliation. The USA Today story claims that the NSA program “does not involve the NSA listening to or recording conversations,” but does use “the data to analyze calling patterns in an effort to detect terrorist activity,” according to their sources. One source says that the NSA program is compiling “the largest database ever assembled in the world,” with the goal of creating “a database of every call ever made” within US borders. President Bush has said that the NSA program is focused exclusively on international calls, and for the calls to be recorded, “one end of the communication must be outside the United States.” However, this is now shown not to be the case (see January 16, 2004). A US intelligence official says that the NSA program is not recording the actual phone calls themselves, but is collecting what he calls “external” data about the communications to allow the agency to emply “social network analysis” for insight into how terrorist networks are connected with one another. Another large telecommunications company, Qwest, has refused to help the NSA eavesdrop on customer calls (see February 2001, February 2001 and Beyond, and February 27, 2001). USA Today’s sources say that the NSA eavesdropping program began after the 9/11 attacks, a claim that is not bolstered by the facts (see 1997, February 27, 2000, February 27, 2000, December 2000, February 2001, February 2001, February 2001 and Beyond, February 2001, Spring 2001, April 2001, April 4, 2001, July 2001, Before September 11, 2001, and Early 2002). The sources say that the three companies agreed to provide “call-detail records,” lists of their customers’ calling histories, and updates, which would allow the agency to track citizens’ calling habits. In return, the sources say, the NSA offered to pay the firms for their cooperation. After the three firms agreed to help the agency, USA Today writes, “the NSA’s domestic program began in earnest” (see After September 11, 2001, After September 11, 2001, October 2001, September 2002, and Spring 2004). NSA spokesman Don Weber says the agency is operating strictly “within the law,” but otherwise refuses to comment. Former US prosecutor Paul Butler says that the Foreign Intelligence Surveillance Act (FISA), which governs surveillance operations by US intelligence agencies, “does not prohibit the government from doing data mining” (see 1978). White House press spokesman Dana Perino says, “There is no domestic surveillance without court approval,” and all surveillance activities undertaken by government agencies “are lawful, necessary, and required for the pursuit of al-Qaeda and affiliated terrorists.” All government-sponsored intelligence activities “are carefully reviewed and monitored,” she adds, and says that “all appropriate members of Congress have been briefed on the intelligence efforts of the United States” (see October 11, 2001 and October 25, 2001 and November 14, 2001). Don Weber, a senior spokesman for the NSA, refuses to discuss the agency’s operations, saying: “Given the nature of the work we do, it would be irresponsible to comment on actual or alleged operational issues; therefore, we have no information to provide. However, it is important to note that NSA takes its legal responsibilities seriously and operates within the law.” All three firms released similar comments saying that they would not discuss “matters of national security,” but were complying with the law in their alleged cooperation with the NSA. The Electronic Frontier Foundation (EFF) is suing AT&T for what it calls its complicity in the NSA’s “illegal” domestic surveillance program (see January 31, 2006). (Cauley 5/11/2006)
Pentagon official Allison Barber circulates a memo destined for the Assistant Secretary of Defense for Public Affairs, Dorrance Smith. The memo suggests that “[b]ased on the success of our previous trips to Iraq with the Retired Military Analysts, I would like to propose another trip to Iraq and Afghanistan. Smith is referencing the Pentagon’s Iraq propaganda operation (see April 20, 2008 and Early 2002 and Beyond), which uses retired military officers as “military analysts” for the various television news channels to promote the Pentagon and White House’s Iraq policies. The same day, Pentagon official Dallas Lawrence, who is directly involved in the propaganda operation (see June 21, 2005 and June 24, 2005), replies to Barber’s memo. Lawrence advises Barber to drop the request for an Afghanistan tour because it may not happen, and by leaving it out of the proposal, “we (you) won’t find yourself having to explain why it didn’t happen after he briefed it to karl at the weekly meeting.” The reference to “karl” cannot be proven to be White House political adviser Karl Rove, but, as Salon columnist Glenn Greenwald will note in 2008, “In the documents I reviewed, I haven’t seen any other ‘Karl’ referenced who works at the [Defense Department]. These are fairly high-ranking [Defense Department] officials and there aren’t many people they’re worried about having to explain themselves to (Smith’s position as Assistant Defense Secretary was one requiring Senate confirmation and he reported to Rumsfeld). Given the significant possibility that this program was illegal (see April 28, 2008 and May 6, 2008), and given [White House Press Secretary Dana] Perino’s denial of the White House’s knowledge of it (see April 30, 2008), this question—whether the ‘karl’ being briefed on the program was Karl Rove—certainly seems to be one that should be asked.” The likelihood that Rove is indeed involved in the propaganda program is bolstered by other Defense Department e-mails from Lawrence and other officials noting that they are attempting to have both President Bush and Deputy National Security Adviser Stephen Hadley (see April 30, 2008), an idea that “was submitted to karl and company from dorrance smith last week.” Greenwald will write that due to the proposed involvement of Bush and Hadley, the “karl” of the memos must by necessity be Karl Rove. If true, Rove’s involvement means that the White House is directly involved in a highly unethical and probably illegal (see April 28, 2008) domestic propaganda operation. (Greenwald 5/16/2008)
A jury finds former White House official Lewis “Scooter” Libby guilty of multiple felonies relating to his divulging the identity of former CIA agent Valerie Plame Wilson’s identity to the press (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Libby is found guilty of two counts of perjury, one count of making false statements, and one count of obstruction of justice. He is acquitted of one count of lying to the FBI, Count Three of the charges. (US District Court for the District of Columbia 3/6/2007 ; Marcy Wheeler 3/6/2007; Washington Post 7/3/2007; BBC 7/3/2007)
No Further Charges - The Associated Press writes, “The trial revealed how top members of the Bush administration were eager to discredit Plame [Wilson]‘s husband, former ambassador Joseph Wilson, who accused the administration of doctoring prewar intelligence on Iraq.” Libby remains expressionless during the reading of the verdicts, but his wife sobs and lowers her head as the verdicts are announced. Prosecutor Patrick Fitzgerald says no additional charges pertaining to the Plame Wilson leak investigation will be filed. “The results are actually sad,” Fitzgerald tells reporters. “It’s sad that we had a situation where a high-level official person who worked in the office of the vice president obstructed justice and lied under oath. We wish that it had not happened, but it did.” Fitzgerald adds that Libby, by lying and obstructing justice, harmed the process of law, and made it more difficult to find out who actually did what in the Plame Wilson leak. Libby the 'Fall Guy'; Memory Defense Implausible - Libby will be sentenced to 30 months in prison (see June 5, 2007). One juror, Denis Collins, tells reporters that he and his fellow jurors found passing judgment on Libby “unpleasant,” but that in final consideration, Libby’s story was too difficult to believe. Collins, a former Washington Post reporter, tells reporters that the jurors had constructed 34 poster-sized pages filled with information they distilled from the trial testimony (see March 1, 2007). They determined that Libby had been told about Plame Wilson’s CIA status at least nine different times, and could not accept the defense’s argument that he forgot about knowing it (see January 31, 2006). “Even if he forgot that someone told him about Mrs. Wilson, who had told him, it seemed very unlikely he would not have remembered about Mrs. Wilson,” Collins says. But, Collins goes on to say, the jurors believe there is more to the story than Libby’s criminal behavior. “We’re not saying we didn’t think Mr. Libby was guilty,” Collins says, “but it seemed like… he was the fall guy” for Vice President Dick Cheney, his former boss. Collins says the jurors felt “a tremendous amount of sympathy” for Libby, and wondered why they were not hearing from other White House officials in Libby’s defense, particularly Cheney and Bush political strategist Karl Rove. “It was said a number of times: ‘What are we doing with this guy here? Where’s Rove? Where are these other guys?’” He says that the testimony of Cheney aide John Hannah was particularly hurtful to Libby’s case (see February 13, 2007), with Hannah seesawing between claiming Libby had an “awful” memory (see January 31, 2006) and then saying he had an incredible grasp of minute details. Collins describes the jury as “dispassionate” in its deliberations, and adds that it took the jury over a week to conclude Libby was guilty of any charges. He says that one juror held out for Libby’s innocence on Count Three, based on reasonable doubt; otherwise the entire jury was unanimous for Libby’s guilt. Fitzgerald says that because Libby lied to both FBI investigators and the grand jury investigating the Plame Wilson identity leak, it became impossible to fully investigate Cheney’s role in leaking Plame Wilson’s covert identity. New Trial? - Libby’s defense attorney, Theodore Wells, says he will request a new trial—something the BBC will call “a common tactic”—and if it is denied, Wells says he will appeal the verdict. Libby is fingerprinted and released on his own recognizance to await sentencing. (Christy Hardin Smith 3/6/2007; BBC 7/3/2007) “We have every confidence Mr. Libby ultimately will be vindicated,” Wells tells reporters. “We believe Mr. Libby is totally innocent and that he didn’t do anything wrong.” (Apuzzo and Sniffen 3/6/2007)
Weeping with Relief - Plame Wilson will recall watching the news on television: “To say I was a bundle of nerves—it felt like I needed two hands to stir the milk in my coffee—would be an understatement.” When the verdicts are read, she begins to “cry with relief,” and immediately calls her husband Joseph Wilson. His response: “Thank God. The charge of obstruction of justice was the most important.” Of her own feelings, Plame Wilson will write, “My feelings of deep sadness over the entire affair were tempered by relief that our justice system still worked as intended.” (Wilson 2007, pp. 294-295)
White House Response - White House deputy press secretary Dana Perino says President Bush watched news of the verdict on television in the Oval Office. Perino says the president respects the jury’s verdict but “was saddened for Scooter Libby and his family.” Perino says the verdict should not be construed as in any way embarrassing for the White House: “I think that any administration that has to go through a prolonged news story that is unpleasant and one that is difficult—when you’re under the constraints and the policy of not commenting on an ongoing criminal matter—that can be very frustrating.” (Apuzzo and Sniffen 3/6/2007)
White House spokeswoman Dana Perino reacts with confusion to Vice President Dick Cheney’s recent assertions that the vice president is neither wholly part of the executive nor legislative branches (see 2003 and June 21, 2007). Perino says in response to reporters’ questions: “I’m not a legal scholar… I’m not opining on his argument that his office is making… I don’t know why he made the arguments that he did.” Reporter Keith Koffler remarks, “It’s a little surreal,” to which Perino replies, “You’re telling me.” Koffler presses, “You can’t give an opinion about whether the vice president is part of the executive branch or not? It’s a little bit like somebody saying, ‘I don’t know if this is my wife or not.’” Asked if President Bush believes Cheney is part of the executive branch, Perino sidesteps, calling it “an interesting constitutional question.” After further dodging, reporter Helen Thomas says, “You’re stonewalling.” Reporter Jim Axelrod suggests Perino is denying “sky-is-blue stuff” and points out that Cheney’s assertion revises “more than 200 years of constitutional scholarship.” Koffler continues, “He can’t possibly argue that he’s part of neither [branch], and it seems like he’s saying he’s part of neither.” Perino finally surrenders, “Okay, you have me thoroughly confused as well.” Cheney’s current position—he will not comply with an order governing the care of classified documents because the vice presidency is not “an entity within the executive branch”—contradicts his 2001 argument that he would not cooperate with a Congressional probe into the activities of his Energy Task Force because such a probe “would unconstitutionally interfere with the functioning of the executive branch.”
'Neither Fish Nor Fowl' - The Washington Post’s Dana Milbank writes, “Cheney has, in effect, declared himself to be neither fish nor fowl but an exotic, extraconstitutional beast who answers to no one.” Senator Charles Schumer (D-NY) agrees, saying: “The vice president’s theory seems to be one almost laughable on its face, that he’s not part of the executive branch. I think if you ask James Madison or Benjamin Franklin or any of the writers of the Constitution, they’d almost laugh if they heard that.” (Milbank 6/26/2007; Dreazen 7/31/2007) Interestingly, Perino does assert that Henry Waxman (D-CA), chairman of the House Oversight and Government Reform Committee, has no standing to investigate the compliance of the vice president’s office with the executive order. “The executive order is enforced solely by the president of the United States,” she says. “I think this is a little bit of a non-issue.” The government watchdog organization Citizens for Responsibility and Ethics in Washington (CREW) retorts that, if Cheney and Perino are to be believed, then the Office of Senate Security, the counterpart to Waxman’s committee, should investigate Cheney’s office. “By claiming the Office of the Vice President is within the legislative branch does Mr. Cheney agree that he is subject to Senate security procedures?” CREW executive director Melanie Sloan asks. “The Security Office’s standards, procedures and requirements are set out in the Senate Security Manual, which is binding on all employees of the Senate.” (Roston 6/24/2007)
The White House denies reports that a secret Justice Department opinion in 2005 authorized the use of torture against detainees suspected of terrorist connections, or superseded US anti-torture laws (see February 2005). Press secretary Dana Perino tells reporters: “This country does not torture. It is a policy of the United States that we do not torture and we do not.” The existence of the 2005 memo, signed by then-Attorney General Alberto Gonzales, was revealed by the New York Times. It apparently superseded a late 2004 memo that characterized torture as “abhorrent” and limited the use of “harsh interrogation techniques” (see December 30, 2004). Perino confirms the existence of the 2005 memo, but will not comment on what techniques it authorized. She merely says that the memo did not reinterpret the law. Justice Department spokesman Brian Roehrkasse says the 2004 opinion remains in effect and that “neither Attorney General Gonzales nor anyone else within the department modified or withdrew that opinion. Accordingly, any advice that the department would have provided in this area would rely upon, and be fully consistent with, the legal standards articulated in the December 2004 memorandum.” Senator John McCain (R-AZ), a consistent opponent of torture, says he was “personally assured by administration officials that at least one of the techniques allegedly used in the past, waterboarding, was prohibited under the new law.” The American Civil Liberties Union (ACLU) calls the 2005 memo and other Justice Department memos authorizing torture “cynical attempt[s] to shield interrogators from criminal liability and to perpetuate the administration’s unlawful interrogation practices.” House Democrats want Steven Bradbury, the acting head of the Justice Department’s Office of Legal Counsel (OLC), to “be made available for prompt committee hearings.” Senator Barack Obama (D-IL), a presidential candidate, says: “The secret authorization of brutal interrogations is an outrageous betrayal of our core values, and a grave danger to our security. We must do whatever it takes to track down and capture or kill terrorists, but torture is not a part of the answer—it is a fundamental part of the problem with this administration’s approach.” Perino does not comment on another secret memo that apparently concluded all of the CIA’s torture methodologies were legal (see Late 2005). Former White House press secretary Scott McClellan says he “passed along false information” at the behest of five top Bush administration officials—George W. Bush, Dick Cheney, Karl Rove, Lewis Libby, and Andrew Card—about the outing of CIA agent Valerie Plame Wilson during his time in the White House. McClellan is preparing to publish a book about his time in Washington, to be titled What Happened: Inside the Bush White House and What’s Wrong With Washington and available in April 2008. (Editor & Publisher 11/20/2007) According to McClellan’s publisher Peter Osnos, McClellan doesn’t believe that Bush deliberately lied to him about Libby’s and Rove’s involvement in the leak. “He told him something that wasn’t true, but the president didn’t know it wasn’t true,” Osnos says. “The president told him what he thought to be the case.” (Rosenkrantz and Fireman 1/20/2007) Early in 2007, McClellan told reporters that everything he said at the time was based on information he and Bush “believed to be true at the time based on assurances that we were both given.” (Apuzzo 11/21/2007) In his book, McClellan writes: “Andy Card once remarked that he viewed the Washington media as just another ‘special interest’ that the White House had to deal with, much like the lobbyists or the trade associations. I found the remark stunning and telling.” (McClellan 2008, pp. 155)
White House Denials; Outrage from Plame, Democrats - White House press secretary Dana Perino says it isn’t clear what McClellan is alleging, and says, “The president has not and would not ask his spokespeople to pass on false information,” adding that McClellan’s book excerpt is being taken “out of context.” Plame has a different view. “I am outraged to learn that former White House press secretary Scott McClellan confirms that he was sent out to lie to the press corps,” she says. Senator Charles Schumer (D-NY) adds, “If the Bush administration won’t even tell the truth to its official spokesman, how can the American people expect to be told the truth either?” (Rosenkrantz and Fireman 1/20/2007; Apuzzo 11/21/2007) Senator and presidential candidate Christopher Dodd (D-CT) calls for a Justice Department investigation into Bush’s role in the Plame outing, and for the new attorney general, Michael Mukasey, to lead the investigation. Alleged Criminal Conspiracy - Investigative reporter Robert Parry writes: “George W. Bush joined in what appears to have been a criminal cover-up to conceal the role of his White House in exposing the classified identity of covert CIA officer Valerie Plame Wilson. That is the logical conclusion one would draw from [McClellan’s book excerpt] when it is put into a mosaic with previously known evidence.” (Parry 11/21/2007) Author and columnist John Nichols asks if McClellan will become the “John Dean of the Bush administration,” referring to the Nixon White House counsel who revealed the details of the crimes behind the Watergate scandal. Nichols writes: “It was Dean’s willingness to reveal the details of what [was] described as ‘a cancer’ on the Nixon presidency that served as a critical turning point in the struggle by a previous Congress to hold the 37th president to account. Now, McClellan has offered what any honest observer must recognize as the stuff of a similarly significant breakthrough.” Former Common Cause President Chellie Pingree says: “The president promised, way back in 2003, that anyone in his administration who took part in the leak of Plame’s name would be fired. He neglected to mention that, according to McClellan, he was one of those people. And needless to say, he didn’t fire himself. Instead, he fired no one, stonewalled the press and the federal prosecutor in charge of the case, and lied through his teeth.” (Nichols 1/21/2007)
The White House confirms that President Bush was told in August 2007 that Iran’s nuclear weapons program “may be suspended,” the conclusion of the recently released National Intelligence Estimate (NIE) (see December 3, 2007). The White House’s admission is a direct contradiction of Bush’s assertion that he only learned of the NIE in late November (see December 3-4, 2007 and November 26-28, 2007). Press secretary Dana Perino says Bush was not told in August of the specifics behind the information about Iran’s nuclear program. Perino says that Director of National Intelligence (DNI) Mike McConnell told Bush in August that the new information might cause the intelligence community to revise its assessment of the Iranian program, but analysts still needed to complete their review before making a final judgment. However, Perino says there is no conflict between her statement and Bush’s insistence that he knew nothing about the substance of the intelligence assessment until late November, because Bush “wasn’t given the specific details” of the revised estimate. Perino’s account raises questions about why, if Bush knew the intelligence community believed Iran’s nuclear weapons program was in abeyance, two months later, he was still giving dire warnings about Iran being a threat to cause “World War III” if not halted (see October 20, 2007). Perino offers an explanation of those warnings, saying, “The president didn’t say we’re going to cause World War III. He was saying he wanted to avoid World War III.” Perino says it is unfair to question Bush’s veracity: “If anyone wants to call the president a liar, they are misreading the situation for their own political purposes. The liar is [Mahmoud] Ahmadinejad [the president of Iran], and he has a lot of explaining to do.”
Reaction - Joseph Biden, a Democratic presidential candidate and the chairman of the Senate Foreign Relations Committee, calls Bush’s explanation unbelievable. “I refuse to believe that,” Biden says. “If that’s true, he has the most incompetent staff in modern American history, and he’s one of the most incompetent presidents in modern American history.” (CNN 12/5/2007) Four former CIA officials call Bush’s claim of ignorance about the Iran intelligence “preposterous.” Melvin Goodman, a 24-year CIA veteran, calls Bush’s claim “unbelievable.” He is joined by Ray McGovern, another CIA veteran who routinely briefed George H. W. Bush during his two terms as vice president; Larry Johnson, the former deputy of the State Department’s Office of Counter Terrorism; and Bruce Riedel, a former National Intelligence Officer for the Near East and South Asian offices. McGovern is almost contemptuous of Bush’s claim: “The notion that the head of National Intelligence whispered in Bush’s ear, ‘I’ve got a surprise for you and it’s really important, but I’m not going to tell you about it until we check it out’—the whole thing is preposterous.” Riedel says that Bush “either chose to ignore what he heard or his director of national intelligence is not doing his job.” He doubts McConnell failed to do his part. “To me it is almost mind boggling that the president is told by the DNI that we have new important information on Iran and he doesn’t ask ‘what is that information?’” Riedel adds. It is not McConnell’s responsibility to tell Bush to “stop hyperventilating about the Iranian threat,” he says, but instead the job of National Security Adviser Stephen Hadley and Bush’s other policy advisers to keep “their eye on the intelligence and to take into account new information as it comes along.” Johnson says that the information used in the NIE would have been available months before it was released to the public, and would have automatically been included in the Presidential Daily Briefing (PDB). Bush would have been told of the intelligence findings, as would Vice President Cheney, Defense Secretary Robert Gates, and Secretary of State Condoleezza Rice. Goodman and McGovern agree with Johnson’s statement. (Edsall and Follmer 12/5/2007) A deconstruction of Bush’s own statements over the last several months indicates that Bush changed his wording in early August, most likely because he was informed about the intelligence findings over Iran (see December 5, 2007).
The White House protests about a sub-heading in a New York Times story on the destruction of CIA videotapes showing detainee interrogations, and the New York Times admits the subheading was misleading and prints a correction. The subheading is “White House role was wider than it said” (in discussions about what to do with the tapes), but White House spokesperson Dana Perino complains. She issues a statement saying that the subheading is “pernicious and troubling,” as it indicates a conscious effort to mislead by the White House, which has not actually yet officially described its role in the tapes’ destruction except to say that President Bush thinks he was not informed. Even though it corrects the subheading, the paper notes that the White House “had not challenged the content of our story.” (Mazzetti and Shane 12/19/2007; Shane 12/20/2007; Abramowitz and Warrick 12/20/2007)
A fire erupts in Vice President Dick Cheney’s ceremonial offices in the Eisenhower Executive Office Building while White House press secretary Dana Perino is answering questions about the destruction of CIA interrogation videos, at approximately 9:15 in the morning, next door at the White House. White House spokesperson Emily Lawrimore says she is unaware of any documents or artwork lost in the fire. DC fire department spokesman Alan Etter says that smoke came from an electrical closet on the second floor, which may have been the location of the fire’s cause. Perino says the fire may have originated in the electrical closet or a phone bank. The vice president’s working office is located in the West Wing of the White House, whereas the Eisenhower Executive Office Building houses the Office of Management and Budget, staff of the National Security Council, other agencies, and the ceremonial offices of the vice president. The adjacent office of the vice president’s political director Amy Whitelaw is heavily damaged in the fire, according to Cheney spokesperson Lea Anne McBride. White House press secretary Dana Perino dismisses a study by the Center for Public Integrity (CPI) that found 935 false statements made by President Bush and seven of his top officials before the invasion of Iraq that helped mislead the country into believing Iraq was an imminent threat (see January 23, 2008). Perino responds: “I hardly think that the study is worth spending any time on. It is so flawed in terms of taking anything into context or including—they only looked at members of the administration, rather than looking at members of Congress or people around the world, because, as you’ll remember, we were part of a broad coalition of countries that deposed a dictator based on a collective understanding of the intelligence.”
CPI Response - CPI’s Charles Lewis, a co-author of the study, retorts that Perino has little credibility because “this is the press secretary who didn’t know about the Cuban Missile Crisis until a few months ago.… [S]he made a reference that she had—actually didn’t know about the Cuban Missile Crisis back in the ‘60s. For a White House press secretary to say that is astonishing to me.” Lewis calls Perino’s comment “predictable,” and cracks, “At least she didn’t call this a third-rate burglary” (see 2:30 a.m.June 17, 1972). “If my administration, that I’m the flack for, made 935 false statements, I would want to say, ‘Go do another study and take ten years and look at the world and Congress.’ The fact is, the world was rallied, as was the compliant Congress, into doing exactly what the administration wanted. And the bottom line is, she didn’t say that they were not false statements. Basically, they acknowledged they were false statements without her saying it. They have essentially said, ‘Gosh, I guess there weren’t any WMDs in Iraq,’ in other statements they’ve made, ‘it’s all bad intelligence.’”
Defense of Analysis - Far from being a flawed and superficial analysis, Lewis says, the analysis supplies “400,000 words of context, weaving in all of this material, not just what they said at the time, but what has transpired and what has tumbled out factually in the subsequent six years. So we actually have as much context so far as anyone has provided in one place. It’s searchable for all citizens in the world and for Congress and others that want to deal with this from here on.” (Goodman 1/24/2008)
With the Protect America Act expiring amid warnings of imminent terror attacks from Bush administration officials and Congressional Republicans (see February 16, 2008 and February 15-17, 2008), most experts outside the administration say its expiration will have little effect on national security. Under the PAA, the government could wiretap domestic phones and computer systems without a warrant, but the legislation was considered a temporary stopgap measure to give Congress and the White House a chance to work together to create new, permanent regulations covering domestic surveillance. The government’s domestic wiretapping program now reverts to the procedures followed for 30 years under the Foreign Intelligence Surveillance Act (FISA), which requires warrants from the FISA Court to engage in surveillance inside the US. Despite administration claims that the paperwork for those warrants is too cumbersome, many experts say that FISA gives the government the tools it needs to spy on terrorists. Timothy Lee from the conservative Cato Institute recalls that the last time FISA was revamped, after the 9/11 attacks, President Bush praised the overhaul, saying it “recognizes the realities and dangers posed by the modern terrorist.” Lee observes: “Those are the rules we’ll be living under after the Protect America Act expires this weekend. There’s no reason to think our nation will be in any more danger in 2008 than it was in 2002, 2003, 2004, 2005, or 2006.” Ben Wittes of the centrist Brookings Institution says that because existing warrantless surveillance begun under the temporary laws could continue for up to a year, the “sky is not falling at all.” Wittes says he is “somewhat bewildered by the apocalyptic rhetoric” of the Bush administration. Many experts note that emergency FISA warrants can, and have, been granted in a matter of minutes, and government eavesdroppers have up to three days to wiretap a phone or computer and then retroactively acquire a warrant. But administration officials have a different view. White House press secretary Dana Perino says the PAA’s expiration “will harm our ability to conduct surveillance to detect new threats to our security, including the locations, intentions and capabilities of terrorists and other foreign intelligence targets abroad.” Perino says that the PAA “temporarily closed” a “dangerous intelligence gap.” House Majority Leader Steny Hoyer (D-MD) calls that warning “categorically false.” Hoyer continues: “In fact, a wide range of national security experts has made clear that the president and our intelligence community have all the tools they need to protect our nation, if the Protect America Act—temporary legislation passed last August—expires.… We believe the president’s rhetoric is inaccurate and divisive, and an attempt to stampede the House of Representatives to rubber-stamp legislation by stoking the fears of the American people. We will not be stampeded.” (Lengell 2/16/2008)
The House Judiciary Committee asks a federal judge to compel two White House officials to testify about the firings of eight US attorneys in 2007. Former White House counsel Harriet Miers and current White House Chief of Staff Joshua Bolten have both refused to testify, ignoring subpoenas from the Judiciary Committee (see February 14, 2008), and Attorney General Michael Mukasey has refused to enforce the subpoenas (see February 29, 2008). The White House steered the refusals. Judge John D. Bates, a federal district court judge in Washington, is overseeing the case. The suit says that neither Miers nor Bolten may avoid testimony by citing executive privilege, as both they and the White House have asserted. White House press secretary Dana Perino calls the suit “partisan theater,” and adds, “The confidentiality that the president receives from his senior advisers and the constitutional principle of separation of powers must be protected from overreaching, and we are confident that the courts will agree with us.” Judiciary Committee chairman John Conyers (D-MI) vehemently disagrees, saying, “The administration’s extreme claim to be immune from the oversight processes are at odds with our constitutional principles.” Conyers warns, “We will not allow the administration to steamroll Congress.” House Minority Leader John Boehner (R-OH) calls the suit a waste of time and accuses the committee of “pandering to the left-wing swamps of loony liberal activists.” The case is central to the ongoing tension between the White House and Congress over the balance of power between the two branches. Constitutional law professor Orin S. Kerr says the case raises fresh issues. While the Supreme Court recognized executive privilege in 1974, it acknowledged that executive privilege was not absolute and could be overturned in some instances, such as a criminal investigation. No court has ruled whether a claim of executive privilege outweighs a Congressional subpoena. According to lawyer Stanley Brand, who is involved in the suit for the Democrats, the committee turned to the legal system to avoid the possibility of charging Miers and Bolten with contempt and trying them in Congress on the charges. Such an action, Brand says, would be unseemly. (House Judiciary Committee v. Miers & Bolten 3/10/2008 ; Lewis 3/11/2008)
Responding to Vice President Dick Cheney’s dismissal of Americans’ lack of support for the Iraq war with the reply, “So?” (see March 19, 2008), a reporter says to White House press secretary Dana Perino that, contrary to Cheney’s assertions of “fluctuations in the public opinion polls,” “It’s not that there’s been fluctuations in polls; it’s been different degrees of opposition to the war. So is the vice president saying it really does not matter what the American public thinks about the war?” Perino responds: “No, I don’t think that’s what he’s saying.… But what he went on to say is that [the] president should not make decisions based on polls.” Another reporter observes: “The American people are being asked to die and pay for this, and you’re saying they have no say in this war?… Well, what it amounts to is you saying we have no input at all.” Perino replies: “You had input. The American people have input every four years, and that’s the way our system is set up.” (White House 3/20/2008) According to polls conducted by the Program on International Policy Attitudes (PIPA) at the University of Maryland, 94 percent of US citizens believe that “leaders should pay attention to the views of the people as they make decisions,” and 81 percent say leaders “should pay attention to public opinion polls because this will help them get a sense of the public’s views.” Steven Kull, the director of PIPA, notes: “While Americans do not say that leaders should always follow the will of the public, they do think that American leaders should be considerably more responsive to the people and should even pay attention to polls. Dismissing the public as irrelevant and incompetent only contributes to already low levels of trust in government.” (World Public Opinion (.org) 3/21/2008)
Reporter Eric Brewer asks White House spokesman Dana Perino about recent reports of the Pentagon’s systematic propaganda operation to manipulate public opinion about the war in Iraq (see April 20, 2008 and Early 2002 and Beyond). After briefly summarizing the story, Brewer asks, “[D]id the White House know about and approve of this operation?” Perino stumbles through her initial response before recovering: “Look, I didn’t know—look, I think that you guys should take a step back and look at this—look, [the Defense Department] has made a decision, they’ve decided to stop this program (see April 26, 2008). But I would say that one of the things that we try to do in the administration is get information out to a variety of people so that everybody else can call them and ask their opinion about something. And I don’t think that that should be against the law. And I think that it’s absolutely appropriate to provide information to people who are seeking it and are going to be providing their opinions on it. It doesn’t necessarily mean that all of those military analysts ever agreed with the administration. I think you can go back and look and think that a lot of their analysis was pretty tough on the administration. That doesn’t mean that we shouldn’t talk to people.” (White House 4/30/2008; Brewer 4/30/2008)
Reporter Helen Thomas, the grande dame of Washington reporters who is not popular with the Bush administration, asks White House spokesman Dana Perino about the five-year anniversary of President Bush’s declaration of “Mission Accomplished” in Iraq (see April 20, 2008 and Early 2002 and Beyond). Thomas asks, “How does the president intend to commemorate ‘Mission Accomplished’ after five years of death and destruction?” Perino responds with the explanation that the banner was merely to acknowledge the completion of the mission of the aircraft carrier on which the ceremony was conducted. “President Bush is well aware that the banner should have been much more specific and said ‘mission accomplished for these sailors who are on this ship on their mission,’” Perino says. “And we have certainly paid a price for not being more specific on that banner. And I recognize that the media is going to play this up again tomorrow, as they do every single year.” (CBS News 10/29/2003; White House 4/30/2008)
White House Press Secretary Dana Perino denies that the White House had any prior knowledge of the Pentagon’s Iraq propaganda operation (see April 20, 2008 and Early 2002 and Beyond). A reporter asks, “Did the White House know about the program?” Perino answers, “I just said: no.” (Brewer 5/14/2008) But a memo in the Pentagon’s own “document dump” about the program (see May 9, 2008) proves otherwise. A July 12, 2005 memo from Donald Rumsfeld to Deputy National Security Adviser Stephen Hadley reads, “Attached is a summary of the effects of the military analysts we took down to GTMO [Guantanamo] earlier this month.” Rumsfeld was presumably referring to the Pentagon-sponsored trip to Guantanamo (see June 24-25, 2005 that was carefully analyzed for its effects in manipulating the media (see June 24, 2005). Senate Democrats and Republicans spar over the just-released Senate Intelligence Committee report about the Bush administration’s use of intelligence in the run-up to war with Iraq (see June 5, 2008). However, no Democrat pushes for criminal charges against any White House officials, and administration officials dismiss the report as “old news.” Committee chairman John D. Rockefeller (D-WV) says of the report: “The tragic fact is, on issues of war and peace, which should require the most meticulous and the most precise adherence to the truth, the administration was too often careless with its words, including in some cases making presentations that were not substantiated by the available intelligence—or worse, directly contradicted by the available intelligence. The administration went well beyond what the intelligence community knew and what it believed.” Rockefeller says pushing for criminal charges would be pointless and would completely shut down already-strained relations between Congress and the White House. “It would mean nothing else, whether it’s clean air or FISA, would get done,” he says. “It’s like pressing for impeachment. It’s a grand act with only five or six months to go. It’s a futile act and it’s a wrong act, because we do have business to do.” Interestingly, Rockefeller acknowledges that charges should be brought, saying: “Should it be done in the wide sweep of history? Yes. Should it be done by us, now? No.” Senator Sheldon Whitehouse (D-RI) says, “It rots the very fiber of democracy when our government is put to these uses.” White House press secretary Dana Perino says that the report actually vindicates the administration in some areas, and in others merely rehashes old claims that the administration has already acknowledged and “taken measures to fix.” Republican committee member Christopher “Kit” Bond (R-MO) calls the report “political theater… that makes partisan points but isn’t grounded in fact,” and adds: “I don’t know why they’re trying to run against the Bush administration. Maybe they think it’s good. But unfortunately it denigrates the process of intelligence collection, analysis and oversight and that’s why it’s a very shabby example of how partisan politics can be misused in the intelligence community.” Former counterterrorism chief Richard Clarke says there must be some accountability: “I just don’t think we can let these people back into polite society and give them jobs on university boards and corporate boards and just let them pretend that nothing ever happened when there are 4,000 Americans dead and 25,000 Americans grievously wounded, and they’ll carry those wounds and suffer all the rest of their lives.” Progressive commentator Arianna Huffington calls the report “a direct rebuke to the administration’s continued claims that it was the intelligence that was faulty, and that Bush and Co. were simply presenting what the CIA had given them.… The report doesn’t use the word, but we all know what it’s called when someone presents something as fact that’s directly contradicted by the evidence. A lie. Not a mistake. A lie.” (Rushing 6/5/2008; Huffington 6/9/2008)
An Iraqi journalist throws a pair of shoes at President Bush during a press conference in Baghdad. In Arab culture, throwing shoes at a person, or showing them the sole of your shoe, is considered a grave insult—shoes are considered ritually unclean. During the conference, Muntadar al-Zaidi, a correspondent for Cairo-based al-Baghdadiya TV, stands up, shouts, “This is a goodbye kiss from the Iraqi people, dog!” and hurls the first shoe. He then shouts, “This is for the widows and orphans and all those killed in Iraq!” and hurls the second shoe. Bush ducks away from the thrown shoes, and both miss their target. Al-Zaidi is wrestled to the floor by security guards within seconds of throwing the second shoe, removed from the room and beaten, and taken into custody where he is soon arrested. Bush brushes aside the incident, telling the remaining journalists, “That’s what people do in a free society, draw attention to themselves,” as al-Zaidi’s screaming can be heard from outside the conference room. Bush flew to Baghdad for a surprise visit. During the momentary chaos after the shoes are hurled, his press secretary, Dana Perino, is struck in the eye with a microphone stand; the blow is accidental. Bush, in the last weeks of his presidency, says that the war in Iraq is not yet over, and more work remains to be done. He will later joke, “If you want the facts, it’s a size 10 shoe that he threw.” Other Iraqi journalists say the attack was symbolic, and note that Iraqis threw shoes and used them to beat statues of Saddam Hussein after his overthrow. Bush says being pelted with shoes may be one of the “weirdest” moments of his presidency. He is accompanied to the press conference by Iraqi Prime Minister Nouri al-Maliki. (Myers and Rubin 12/14/2008; BBC 12/15/2008; Asser 12/15/2008; Stone 12/15/2008) Bush later compares the incident to the disruption of an earlier White House press conference with Chinese President Hu Jintao by a Falun Gong follower, and says it would be wrong to read the feelings of an entire country into the single instance. “I don’t think you can take one guy and say this represents a broad movement in Iraq,” he says. He notes that the other Iraqi journalists in the room “were very apologetic and said this doesn’t represent the Iraqi people.” (Stone 12/15/2008)
Others' Reactions - A former colleague of Al-Zaidi, Haider Nassar, explains, “He had bad feelings about the coalition forces.” Of al-Zaidi’s actions, Nassar says it is a poor way to establish his points. “This is so silly; it’s just the behavior of an individual,” Nassar says. “He destroyed his future.” (Myers and Rubin 12/14/2008) Adil Shamoo, an Iraqi analyst at the Institute for Policy Studies in Washington, says of the incident: “I think we should go beyond the shoe and think about the fact that the US should respect Iraq’s sovereignty in order to regain respect of the Iraqi people and the Arab world. I think Bush has increased terrorism against the United States and instablity in the Middle East because of his policies.” (Al Jazeera 12/15/2008)
History of Shoes Used to Insult Americans - This is not the first time Iraqis have used shoes to insult American officials. Until the 2003 invasion, a likeness of Bush’s father, former President George H. W. Bush, was prominently featured in a floor mosaic near the front door of Baghdad’s Rashid Hotel; visitors would tread on it in symbolic punishment for alleged “war crimes” committed during the 1991 Gulf War. (The likeness has since been removed.) In 2004, the corpses of four American mercenaries killed and strung up on a bridge in Fallujah (see March 31, 2004) were beaten with shoes by local citizens. Posters of the current president, adorned with shoes, are common sights in many parts of Iraq and other Middle Eastern countries. And Secretary of State Condoleezza Rice has been given the insulting nickname of “Kundera,” meaning shoe, by many Middle Easterners. (Asser 12/15/2008; Stone 12/15/2008) In late January, an Iraqi orphanage will unveil a “shoe monument” in honor of al-Zaidi’s act (see January 29, 2009). Al-Zaidi will be freed from prison in September 2009 (see September 14, 2009).
According to an analysis by the progressive media watchdog organization Media Matters, Fox News has become the place for eight former Bush administration officials and other Republican lawmakers, strategists, and future presidential candidates to espouse their views (see October 13, 2009). Media Matters says “[a] revolving door exists between the Republican Party and Fox News Channel… further demonstrating that Fox is effectively a conservative political organization and not a legitimate news outlet.” Media Matters analyzed Fox News broadcasts aired between September 1 and mid-October.
Karl Rove - The former deputy chief of staff of the Bush White House, Karl Rove, the Bush administration’s chief political adviser, is now labeled as a political adviser and commentator for Fox. He appears, on average, twice a week, usually on prime-time programs hosted by Sean Hannity and Bill O’Reilly.
Dana Perino - Formerly the White House press secretary, Dana Perino is now a frequent contributor and analyst for Fox, and writes a column for Fox Forum. Perino appears most often on Hannity’s show, though she has made several appearances on Fox Business Channel.
John Bolton - The former ambassador to the United Nations, John Bolton is now a regular Fox contributor and analyst.
Mike Huckabee - Mike Huckabee, the ex-governor of Arkansas and dark-horse presidential candidate in 2008 has his own show, Huckabee, on Fox. Frequently, Huckabee directs viewers to “go to balancecutsave.com,” which redirects visitors to a Web page soliciting donations for his political action committee, which financially supports Republican candidates and also pays his daughter’s salary.
Newt Gingrich - Newt Gingrich is the former speaker of the House and a possible presidential candidate in 2012. He has been a regular on Fox since singing a contract with the network in 1999 after resigning from the House in disgrace.
John Kasich - Formerly a Republican House member from Ohio and now a candidate for governor of Ohio, John Kasich used to host a show on Fox, Heartland with John Kasich. He is a regular contributor and commentator on several Fox prime-time broadcasts.
Dick Morris - A Republican who once crossed party lines to advise then-President Clinton, Dick Morris is a frequent guest on Fox, appearing at least 20 times since September 1, usually on shows hosted by Hannity, O’Reilly, or Greta Van Susteren. During the 2008 election cycle, Morris repeatedly urged viewers to donate to an anti-Obama political action committee, without divulging that the PAC had paid a firm connected to him. Morris also uses his Fox appearances to raise funds for a conservative group of which he is chief strategist.
Frank Luntz - Frank Luntz, a GOP strategist and pollster, regularly appears on Fox shows hosted by Hannity, O’Reilly, and Glenn Beck, who asked Luntz to instruct his audience on the signs “the tea party people should be carrying.” (Media Matters 10/26/2009)
Former Bush administration press secretary Dana Perino tells a Fox News audience that no terrorist attacks took place on American soil during President Bush’s two terms. Perino is forgetting, or ignoring, the 9/11 attacks, the most lethal and costly attacks in US history. On Sean Hannity’s Fox show, Hannity asks Perino if President Obama “really understand[s]” that the US has a national security concern about terrorism. Perino begins by denying that her remarks are political, then says that the US recently suffered “a terrorist attack on our country,” obviously referring to the 9/11 attacks. The Obama administration is loath to call the US’s involvement a “war on terror,” Perino says, when it should be labeled as such “because we need to face up to it so we can prevent it from happening again.” She says she does not know what thinking is going on in the Obama administration, “but we did not have an attack on our country during President Bush’s term. I hope they’re not looking at this politically. I do think we owe it to the American people to call it what it is.” Neither Hannity nor his other guest, Fox Business personality Stuart Varney, correct Perino’s statement; instead Varney begins questioning Obama’s commitment to fighting terrorism. (Media Matters 11/24/2009) Perino had not yet joined the Bush administration in 2001, but was working as a public relations representative for a high-tech firm in San Diego. (Brass 9/21/2007)
Fox News’s Eric Bolling, hosting The Five, says that he remembers no terrorist attacks on the US during the Bush presidency. Bolling is either ignoring or forgetting that the 9/11 attacks, the most lethal and costly terrorist attacks in US history, occurred eight months into the Bush presidency. Since late 2009, two former Bush administration officials have also denied that 9/11 took place during the Bush presidency (see November 24, 2009 and December 27, 2009), as has former New York City Mayor Rudolph Giuliani, who was mayor when his city was stricken (see January 8, 2010). A Las Vegas newspaper publisher has claimed no terrorist attacks occured during the Bush administration after 9/11, another falsehood perpetrated by Bolling (see January 3, 2010). One of the “five” participants in the roundtable discussion on the show is former Bush administration press secretary Dana Perino, who is one of the former administration officials who denied that 9/11 took place during Bush’s presidency. Bolling and the other participants, save for the single “liberal” at the table, Bob Beckel, are criticizing the Obama administration’s economic policies. The topic goes into a quick repudiation of the fact that the Bush administration used false claims about WMDs to drive the US into a war with Iraq, and Bolling shouts over the crosstalk: “America was certainly safe between 2000 and 2008. I don’t remember any terrorist attacks on American soil during that period of time.” No one involved in the panel discussion corrects his misstatement. (Media Matters 7/13/2011; Huffington Post 7/14/2011) The Five is the newest Fox News offering, replacing the recently canceled show hosted by Glenn Beck. (Huffington Post 7/14/2011) The next day, MSNBC talk show host Chris Matthews derides what he calls Bolling’s “revisionist history” regarding 9/11. He plays a brief clip of Bolling making the statement, then sarcastically invites Bolling to “think back to 2001.” While playing a clip from the coverage of the 9/11 attacks, Matthews asks, “Does that trigger your memory?” (Media Matters 7/14/2011) Hours after Matthews’s correction, Bolling says on The Five: “Yesterday I misspoke when saying that there were no US terror attacks during the Bush years. Obviously I meant in the aftermath of 9/11.” Bolling then swings to the attack, saying: “That’s when the radical liberal left pounced on us and me. [The progressive media watchdog Web site] Media Matters posted my error, saying I forgot about 9/11. No, I haven’t forgotten.” (Bolling is referring to a Media Matters article with the title: “‘Have You Forgotten?’ Conservatives Erase 9/11 From Bush Record,” which cites Bolling’s error among other “misstatements” and omissions by conservatives, and cites the numerous terror attacks that took place on US soil after 9/11 during the Bush presidency.) Bolling continues by saying he was in New York during the attacks, lost friends during the attacks, and comforted the children of friends who were terrified by the attacks.
