Abe Fortas resigns from the Supreme Court under pressure. Fortas, a liberal Democrat and political crony of outgoing president Lyndon Johnson, was originally chosen by Johnson to replace retiring Chief Justice Earl Warren, but conservatives in the Senate blocked Fortas’s confirmation (see June 23, 1969). President Nixon intended to fill the Court with as many of his choices as possible, and he, along with conservative Republicans and Democrats who do not agree with Fortas’s liberal stance on civil rights, targeted Fortas for a smear campaign designed to force him off the bench. Nixon used what White House counsel John Dean will later call “an ugly bluff” against Fortas: He has Attorney General John Mitchell inform Fortas that he intends to open a special probe into Fortas’s dealings—while on the bench—with a financier already under investigation. Mitchell insinuates that he will put Fortas’s wife, herself an attorney and partner at Fortas’s former law firm, and other former partners of Fortas’s on the witness stand. Whether Fortas actually had any direct illegal dealings with this financier is unclear—certainly his dealings had such an appearance—but the bluff worked; Fortas agreed to retire early, thus clearing a position on the Court for Nixon to fill. Nixon will find it difficult to replace Fortas with one of the Southern conservatives he wants on the Court; Senate Democrats will lead successful efforts to block the nomination of two of Nixon’s nominees, the respected, moderately conservative Clement Haynsworth, and the virulently racist G. Harrold Carswell, himself recommended by Mitchell’s assistant, William Rehnquist. (Carswell’s failed nomination will produce a memorable statement from Senator Roman Hruska (R-NE), who, in defense of Carswell, tells the Senate: “Even if he is mediocre, there are a lot of mediocre judges and people and lawyers. They are entitled to a little representation, aren’t they, and a little chance?”) Nixon will use the defeats to make political hay in the South by claiming that Senate Democrats do not want a Southerner on the bench. As another assignment for the newly formed “Plumbers” (see Late June-July 1971), President Nixon orders chief of staff H. R. Haldeman to have the Brookings Institute burglarized (see June 17, 1972). The Brookings Institute is a Washington think tank which Nixon believes has copies of the Pentagon Papers. As secretly recorded, Nixon tells Haldeman: “I want the break-in. Hell, they do that” [presumably referring to the Democrats]. “They have a lot of material. I want—the way I want that handled, Bob, is get it over. I want Brooking. Just break in. Break in and take it out. You understand.” Haldeman replies: “Yeah. But you have to get somebody to do it.” Nixon says: “Well, you—that’s what I’m just telling you. Now don’t discuss it here. You’re to break into the place, rifle the files, and bring them out.” Haldeman is untroubled by the order: “I don’t have any problem with breaking in.” Nixon is direct in his orders for the burglary: “Just go in and take them. Go in around 8 or 9 o’clock. That’s right. You go in and inspect and clean it out.… We’re up against an enemy, a conspiracy. They’re using any means. We are going to use any means. Is that clear?” The next day, Nixon repeats: “Get it done. I want it done. I want the Brookings Institute’s safe cleaned out.” (PBS 1/2/1997; Reeves 2001, pp. 339; Werth 2006, pp. 84-87)
"Talk to Hunt" - When asked who will do it, Nixon replies: “That’s what I’m talking about. Don’t discuss it here. You talk to Hunt.” Nixon is referring to E. Howard Hunt, a recently retired CIA officer currently performing secret operations for Nixon’s aide Charles Colson. Haldeman says approvingly that CIA director Richard Helms “says he’s ruthless, quiet, careful. He’s kind of a tiger.… He spent 20 years in the CIA overthrowing governments.” (Reeves 2001, pp. 339)
"Black-Bag" Team Assembled - Ehrlichman’s deputies Egil “Bud” Krogh and David Young, whom he has put in charge of the operation, soon report that they’ve assembled a “black-bag” team and have recommended a “covert operation” to burglarize an office at the Institute. (Krogh sums up Nixon’s thinking quite eloquently: “Anyone who opposes us, we’ll destroy. As a matter of fact, anyone who doesn’t support us, we’ll destroy.”) Ehrlichman approves the project, noting it must not be “traceable.” The same team of burglars who rifle the office will later be used to break into the Democratic headquarters at the Watergate Hotel (see 2:30 a.m.June 17, 1972). (PBS 1/2/1997) Ehrlichman will later claim that the Institution was never burglarized because he “shot it down” (see Late December-Early January 1997). (Herda 1994)
Newspaper Editor Targeted for Burglary - Another project, which also apparently never takes place, involves stealing documents from the safe of the editor of the Las Vegas Sun, Hank Greenspun. “Plumbers” burglar James McCord will later explain that Greenspun is a target because of his relationship with eccentric billionaire Howard Hughes and former Hughes associate Robert Maheu, and that Maheu has damaging information on a Democratic presidential candidate, Edmund Muskie, that the Nixon aides want. However, author Carl Oglesby will later claim that the material refers to Nixon and not to Muskie. (Spartacus Schoolnet 8/2007; Spartacus Schoolnet 8/2007) In 2001, historian Richard Reeves writes that the files contain information about Nixon and Democratic National Committee chairman Lawrence O’Brien. Nixon’s close friend and political financier Charles “Bebe” Rebozo had just gotten $50,000 in campaign cash from Hughes, and O’Brien is earning $13,000 a month lobbying for one of Hughes’s corporations. Call Girl Operation Turned Down - Another “Plumber,” G. Gordon Liddy, suggests using a coterie of Washington, DC call girls to infiltrate the Democratic campaign organization and bring out information, a suggestion that is not seriously considered. (Spartacus Schoolnet 8/2007)
Inappropriate Conversation? - During the discussion, White House counsel John Dean interrupts to say, “Excuse me for saying this, but I don’t think this kind of conversation should go on in the attorney general’s office.” They are meeting in the office of Attorney General John Mitchell. (Reeves 2001, pp. 431)
A staff aide to President Nixon, former New York City police detective Jack Caulfield, develops a broad plan for launching an intelligence operation against the Democrats for the 1972 re-election campaign, “Operation Sandwedge.” The original proposal, as Caulfield will later recall, is a 12-page document detailing what would be required to create an “accurate, intelligence-assessment capability” against not just the Democrats but “also to ensure that the then powerful anti-war movement did not destroy Nixon’s public campaign, as had been done to Hubert Humphrey in 1968” (see November 5, 1968). Sandwedge is created in anticipation of the Democrats mounting their own political espionage efforts, which Caulfield and other Nixon aides believe will use a private investigations firm, Intertel, headed by former Justice Department officials loyal to former Attorney General Robert F. Kennedy. Caulfield will later recall, “Intertel represented, in my opinion, the potential for both formidable and sophisticated intelligence opposition tactics in that upcoming election campaign.” Sandwedge is turned down by senior White House aides in favor of the “Special Investigation Unit” (see March 20, 1971 and September 29, 1972) headed by G. Gordon Liddy. Caulfield resigns from the White House shortly thereafter. He will later call the decision not to implement “Sandwedge” a “monumental” error that “rapidly created the catastrophic path leading directly to the Watergate complex—and the president’s eventual resignation.” Caulfield has little faith in Liddy, considering him an amateurish blowhard with no real experience in intelligence or security matters; when White House counsel John Dean asks him for his assessment of Liddy’s ability to run such an operation, he snaps, “John, you g_ddamn well better have him closely supervised” and walks out of Dean’s office. Caulfield later writes, “I, therefore, unequivocally contend that had there been ‘Sandwedge’ there would have been no Liddy, no Hunt, no McCord, no Cubans (see 2:30 a.m.June 17, 1972) and, critically, since I had personally decided to negate, while still on the White House staff, a developing intelligence interest by Dean in the Watergate’s Democratic National Committee offices, seven months prior to the break-in! NO WATERGATE!” (John J. 'Jack' Caulfield 2006; Spartacus Schoolnet 8/2007)
Deputy Attorney General William Rehnquist is sworn in as an associate justice of the Supreme Court, replacing the retiring John Harlan. Rehnquist was active in the Arizona Republican Party, and became well-known in the state as a conservative activist who, among other things, opposed school integration. Rehnquist befriended fellow Phoenix attorney Richard Kleindienst, who, after becoming attorney general under Richard Nixon, brought Rehnquist into the Justice Department. Rehnquist faced little difficulty in his confirmation hearings in the Democratically-led Senate Judiciary Hearings. (Oyez (.org) 9/3/2005) Rehnquist may have perjured himself during those hearings. He was confronted with charges that, as a Republican Party attorney and poll watcher, he had harassed and challenged minority voters in Arizona during the 1962, 1964, and 1966 elections. Rehnquist swore in an affidavit that the charges were false, even though the evidence available to the Senate showed Rehnquist did take part in such activities, which were legal in Arizona at the time. (Rehnquist will again deny the charges in 1986, when he is nominated for chief justice—see September 26, 1986). Former Nixon White House counsel John Dean will observe: “After reading and rereading his testimony, it appears to me that what he was really saying to the Senate [in 1971] was that he was not quite sure himself of his behavior, but he could not bring himself to tell the truth. Thus, his blanket 1971 denial forced him to remain consistent to that denial in 1986, and since his blanket denial was a lie, he had to continue lying. His false statement to Congress in 1971 was a crime, but the statute of limitations had passed. His false statement to Congress in 1986, however, was pure perjury.” (Dean 2007, pp. 129-137)
“Plumber” G. Gordon Liddy lays out an elaborate $1 million proposal for a plan for political espionage and campaign “dirty tricks” he calls “Operation Gemstone” to Attorney General John Mitchell. Mitchell is preparing to leave his post to head the Committee to Re-elect the President (CREEP—see March 1, 1972). “Gemstone” is a response to pressure from President Nixon to compile intelligence on Democratic candidates and party officials, particularly Democratic National Committee chairman Lawrence O’Brien. Liddy gives his presentation with one hand bandaged—he had recently charred it in a candle flame to demonstrate the pain he was willing to endure in the name of will and loyalty. Sub-operations such as “Diamond,” “Ruby,” and “Sapphire” engender the following, among other proposed activities:
disrupt antiwar demonstrators before television and press cameras can arrive on the scene, using “men who have worked successfully as street-fighting squads for the CIA” (Reeves 2001, pp. 429-430) or what White House counsel John Dean, also at the meeting, will later testify to be “mugging squads;” (Time 7/9/1973)
kidnap, or “surgically relocate,” prominent antiwar and civil rights leaders by “drug[ging” them and taking them “across the border;”
use a pleasure yacht as a floating brothel to entice Democrats and other undesirables into compromising positions, where they can be tape-recorded and photographed with what Liddy calls “the finest call girls in the country… not dumb broads but girls who can be trained and photographed;”
deploy an array of electronic and physical surveillance, including chase planes to intercept messages from airplanes carrying prominent Democrats. (Reeves 2001, pp. 429-430)
Dean, as he later testifies, is horrified at the ideas. (Time 7/9/1973) Mitchell seems more amused than anything else at Liddy’s excesses, he merely says that “Gemstone” is “not quite what I had in mind.” He tells Liddy and Liddy’s boss, CREEP deputy director Jeb Stuart Magruder, to come back with a cheaper and more realistic proposal. (Reeves 2001, pp. 429-430)
W. Mark Felt, the number three official at the FBI, is given the memo allegedly written by ITT lobbyist Dita Beard (see February 22, 1972) by Assistant Attorney General L. Patrick Gray to have it forensically analyzed. However, Gray soon demands the memo’s return. Felt has the memo analyzed, but no solid conclusions as to its validity can be initially determined. Shortly after returning the memo to Gray, Felt receives a phone call from White House counsel John Dean; Dean tells Felt that ITT experts had determined that the Beard memo was a forgery. On March 17, as Beard is denying writing the memo, FBI analysts report to Felt that the memo is likely authentic. Before the FBI can release its findings to the public, Dean presses Felt to change the letter; both Felt and FBI Director J. Edgar Hoover refuse, and Hoover releases the finding on March 23. Hoover even refuses a direct request from President Nixon to back off on the finding of authenticity. Felt feels that the request is nothing less than pressure from the White House to cover up the ITT-GOP connection, pressure which Felt will later characterize as “in some ways a prelude to Watergate.” (Gentry 2001, pp. 716-717; Woodward 2005, pp. 37-39)
Shortly after the Watergate burglars were caught (see 2:30 a.m.June 17, 1972), Nixon campaign aide Gordon Strachan destroys evidence that could link the White House to the burglaries. According to testimony by White House counsel John Dean to the Senate Watergate Committee (see June 25-29, 1973), Strachan, on the orders of White House aide H. R. Haldeman, destroys files from Haldeman’s office, including what Dean calls “wiretap information from the DNC,” or Democratic National Committee. Dean later testifies that White House aide John Ehrlichman orders him to get E. Howard Hunt, the planner of the burglary, “out of the country,” but later tries to rescind the order. Dean’s testimony shows that Haldeman had prior knowledge of the illegal wiretapping and perhaps the burglaries as well. Dean’s testimony implicates both Haldeman and Ehrlichman as direct participants in the cover-up virtually from the outset. (Time 7/9/1973)
White House counsel John Dean informs Attorney General Richard Kleindienst that “this matter [the Watergate burglary (see 2:30 a.m.June 17, 1972)] could lead directly to the White House.” Kleindienst is already aware of the possible link to the White House (see June 17, 1972). Kleindienst informs Deputy Attorney General Henry Peterson of Dean’s statement. Neither official divulges the possibility of a White House connection in the burglary to the FBI. (O.T. White House counsel John Dean orders the opening of a safe belonging to Watergate burglar E. Howard Hunt (see 2:30 a.m.June 17, 1972). Dean orders that the contents be turned over (six days later, after Dean and other White House officials have had a chance to peruse them) to the FBI. The documents will soon be given to FBI acting director L. Patrick Gray, who keeps them for six months before burning them (see Late December 1972). Gray will later admit to the incident in his testimony before the Senate Watergate Committee (see February 28-29, 1973). (Time 4/2/1973) Dean finds in the safe, among other things, a loaded .25 caliber pistol; the attache case of burglar James McCord, loaded with electronic surveillance equipment and a tear gas canister; CIA psychological profiles of Pentagon Papers leaker Daniel Ellsberg (see March 1971); pages from the Pentagon Papers; memos to and from Nixon aide Charles Colson; two falsified diplomatic cables implicating former President John F. Kennedy in the 1963 assassination of South Vietnam’s President Ngo Diem Dinh; and a dossier on the personal life of Senator Edward Kennedy (D-MA). Nixon aide John Ehrlichman advises Dean to throw the contents of the safe into the Potomac River. (Reeves 2001, pp. 501-502) Shortly thereafter, Washington Post reporter Carl Bernstein, in discussions with a young assistant in White House aide Charles Colson’s office, learns that Hunt has been investigating Kennedy’s checkered past, particularly the Chappaquiddick tragedy of 1969, in which an apparently inebriated Kennedy drove his car into a lake, drowning his companion of the evening, Mary Jo Kopechne. Hunt was apparently looking for political ammunition against Kennedy in preparation for a possible presidential run. According to a former Nixon administration official, Colson and fellow Nixon aide H. R. Haldeman were “absolutely paranoid” about a Kennedy campaign run. (Bernstein and Woodward 1974, pp. 30-31)
The FBI’s acting director, L. Patrick Gray, authorizes White House counsel John Dean to sit in on the FBI’s interview of White House special counsel Charles Colson—in fact, the interview is conducted in Dean’s office. The order apparently originates with President Nixon, or Nixon’s senior aide John Ehrlichman, and not Gray. Dean is thus able to monitor and supervise everything that Colson says, and report his findings to the White House. Dean will be allowed to sit in on many subsequent FBI interviews of White House personnel; furthermore, all such requests for interviews will go through Dean, and Gray will even give Dean the FBI investigative reports. In its internal review of the FBI’s investigation two years later, the Office of Planning and Evaluation will call this Gray’s most “serious blunder from an investigative standpoint… obviously the furnishing to Dean by Mr. Gray of our reports allowed Dean the total opportunity to plan a course of action to thwart the FBI’s investigation and grand jury inquiry.” It is clear, the report will find, that Dean had ample opportunity to prepare White House officials as to what to say and what to conceal, and gave Dean “time to set the stage in order that the results of that investigation would be more favorable to Dean’s ultimate ends.” (O.T. During the FBI interview of Charles Colson in White House counsel John Dean’s office (see June 22, 1972), Colson tells the FBI investigator that Watergate burglar E. Howard Hunt’s office is on the third floor of the White House. The investigator asks if they can all go to Hunt’s office and see if Hunt, who has disappeared from view (see June 18, 1972), may have left something of interest there. Dean says he did not know until now that Hunt had an office in the White House. Dean refuses to let the FBI agent go to Hunt’s office, and promises to turn over anything in the office to the FBI. Four days later, Dean and his assistant, Fred Fielding, turn over two separate boxes of innocuous personal effects from Hunt’s office. The FBI later notes that it could not insist on visiting Hunt’s office because the agent lacked a search warrant. (O.T. Jacobson 7/5/1974 )
White House counsel John Dean meets with Vernon Walters, the deputy director of the CIA, to ask if the agency can provide “financial assistance” to the five Watergate burglars. Two days later, after checking with his boss, CIA director Richard Helms, Walters refuses Dean’s request. Dean informs his White House and Nixon campaign associates, John Mitchell, Frederick LaRue, and Robert Mardian. On June 29, Dean meets with President Nixon’s personal lawyer, Herbert Kalmbach, and tells him that Mitchell, along with Nixon’s two top aides, H. R. Haldeman and John Ehrlichman, want Kalmbach to raise money for the Watergate burglars. Later that day, the finance chairman of the Nixon re-election campaign, Maurice Stans, gives Kalmbach $75,000 for the burglars. Over the next months, money will continue to be raised and disbursed to the burglars in what may be part of a blackmail scheme orchestrated by one of them, E. Howard Hunt (see March 21, 1973). FBI Director L. Patrick Gray meets with White House aides John Ehrlichman and John Dean in Ehrlichman’s White House office. Dean gives Gray two files that he says came from Watergate burglar E. Howard Hunt’s office safe (see June 22-26, 1972). Gray should keep the files, Dean says; they are “political dynamite” that “should never see the light of day.” Gray will later burn the files rather than turn them over to the FBI (see April 27-30, 1973). (O.T. Jacobson 7/5/1974 ) According to Dean’s later testimony to the Senate Watergate Committee (see June 25-29, 1973), among the contents is a briefcase containing “loose wires, Chap Sticks with wires coming out of them, and instruction sheets for walkie-talkies.” (Time 7/9/1973) According to Washington Post reporter Bob Woodward’s FBI source W. Mark Felt, Ehrlichman tells Dean, “You go across the [Potomac] river every day, John. Why don’t you drop the g_ddamn f_cking things in the river?” (Bernstein and Woodward 1974, pp. 305-306) Dean tells Ehrlichman “in a joking manner that I would bring the materials over to him and he could take care of them because he also crossed the river on his way home. He said no thank you.” It was after that discussion that the decision was made to give the evidence to Gray. (Time 7/9/1973) Gray keeps the files for about a week, then puts them in an FBI “burn bag.” A Dean associate later tells Post reporter Carl Bernstein, “You ever heard the expression ‘deep six’? That’s what Ehrlichman said he wanted done with those files.” (Bernstein and Woodward 1974, pp. 305-306)
CIA Director Richard Helms confers with FBI Director L. Patrick Gray over the FBI’s investigation into the Mexican bank account apparently used to launder illegal campaign contributions (see Before April 7, 1972). Helms tells Gray that the Midwest finance chairman of the Nixon campaign, Kenneth Dahlberg, last had contact with the CIA in 1961. The FBI is not sure what the nature of this contact between Dahlberg and the CIA is. The next day, Gray tells his deputy, Mark Felt, that neither Dahlberg nor Mexican lawyer Manuel Ogarrio Daguerre (see Before April 7, 1972) are to be interviewed because of “national security considerations.” The CIA’s deputy director, Vernon Walters, will tell Gray on June 27 and 28 that neither Dahlberg nor Ogarrio have any connection with the agency, and the CIA has no reason to object to their being interviewed. Gray will give belated permission for the FBI to interview the two on July 6, 1972. Dahlberg will initially lie to the FBI about some of the money he collected that found its way into the account of one of the Watergate burglars (see 2:30 a.m.June 17, 1972). Ogarrio will also be interviewed, but only after Dean reverses his initial decision not to allow the FBI to talk with him. Acting FBI Director L. Patrick Gray refuses to allow FBI investigators to interview Kathleen Chenow, a former secretary to David Young. Young, a former aide to White House special counsel John Ehrlichman, is one of the lawyers tasked with coordinating the activities of the “Plumbers” (see Late June-July 1971). Gray says that he cannot allow the agents to interview Chenow because of “national security” concerns. Gray will later tell investigators that Chenow has returned to the US in a military helicopter, in the company of Fred Fielding, the assistant to White House counsel John Dean (see June 22, 1972). Fielding was ordered by Dean to find Chenow and bring her in to speak to the FBI. Gray then permits the FBI to interview Chenow, in Dean’s presence. Chenow is not forthcoming. The FBI will later note, “It appears likely the reason we had to wait to interview Chenow was because Dean wanted to brief her beforehand.” Similarly, Gray will delay FBI interviews with Young until Dean has a chance to confer with the former White House aide. White House counsel John Dean meets with President Nixon’s personal lawyer, Herbert Kalmbach, in Lafayette Park near the White House. Away from possible eavedropping, Dean tells Kalmbach that his job is to secretly raise money for the Watergate defendants (see June 20-21, 1972). The money is to be delivered by former New York policeman and Nixon campaign operative Tony Ulasewicz (see March 20, 1971). Kalmbach checks into a room at the Statler Hilton, where campaign finance chairman Maurice Stans gives him a briefcase containing $70,000 in $100 bills. (Reeves 2001, pp. 572) Kalmbach will distrubute $187,000 in “hush money” to the burglars over the next three months; after that, the distribution will be handled by former Mitchell aide Frederick LaRue, who will hand out another $230,000. Nixon will claim he knew nothing of this until informed by White House counsel John Dean in March 1973 (see March 21, 1973), but author James Reston, Jr will later write that Kalmbach’s involvement is “strong circumstantial” evidence “that Nixon must have known about the process from the beginning. Had the president’s lawyer been caught at this task, it would have associated the president with the break-in in the summer of 1972, and no one but Nixon would logically have authorized such a risky procedure.” (Reston 2007, pp. 34)
Watergate burglar E. Howard Hunt emerges from hiding (see June 18, 1972). In the following days, Washington reporter Carl Bernstein learns that Hunt’s lawyer William O. Bittman had received $25,000 in cash to represent Hunt. Bernstein learns this from a legal colleague of Bittman’s, who is disturbed that such a well-respected attorney as Bittman—a former assistant attorney general in the Justice Department—might have taken illicit monies. Bittman’s colleague also tells Bernstein that the Committee to Re-elect the President (CREEP) has earmarked at least $100,000 for something committee officials call “Convention Security.” Bittman refuses to confirm or deny the transaction. (Bernstein and Woodward 1974, pp. 34) According to later testimony by senior campaign aide Frederick LaRue, LaRue gave $210,000 in CREEP slush fund money to Bittman for Bittman to distribute to the seven defendants. LaRue will claim he gave Bittman the money on the orders of White House counsel John Dean. (O.T. Jacobson 7/5/1974 )
White House aide John Ehrlichman tells President Nixon that the deputy director of the Committee to Re-elect the President (CREEP), Jeb Magruder, is probably the next CREEP official to, in his words, “take the slide” over the Watergate burglary (see 2:30 a.m.June 17, 1972). “[H]e’ll just have to take whatever lumps come, have to take responsibility for the thing,” Ehrlichman says. “They’re not going to be able to contrive a story that indicates that he didn’t know what was going on.” White House counsel John Dean is working on the new angle now. Nixon asks, “Did [Dean] know?” and Ehrlichman replies: “Oh Lord, yes. He’s in it with both feet.” Nixon continues: “He won’t contrive a story, then.… If you cover up, you’re going to get caught. And if you lie, you’re going to be guilty of perjury.” Nixon adds, “[W]e’ll take care of Magruder immediately afterwards” (alluding to pardoning Magruder after he is convicted). Nixon has one major worry about Magruder’s testimony to the FBI: “The main thing is whether he is the one where it stops. Or whether he goes to [former CREEP director John] Mitchell or [Nixon’s chief of staff H. R.] Haldeman.” (Reeves 2001, pp. 515-516)
FBI Director L. Patrick Gray begins sending FBI investigation files, including classified 302 files (raw interview materials), to White House counsel John Dean (see June 22, 1972). Gray does not clear the reports through the office of the attorney general, as he is mandated by law to do. Gray has no authority under the law to transfer the files to anyone, particularly those who are connected to the subjects of FBI investigations. (O.T. Jacobson 7/5/1974 )
President Nixon and his chief of staff, H. R. Haldeman, are cautiously optimistic that the FBI investigation of the Watergate burglary is being contained (see June 20, 1972). White House counsel John Dean seems to be in control (see June 22, 1972 and July 21, 1972), and so far, no one interviewed by the FBI is giving information about any connections to high-ranking White House officials. Nixon and Haldeman even find some humor in the situation. “What [Watergate burglar E. Howard] Hunt is doing is using all of the g_ddamn permissive crap that the previous Supreme Court has given us for his purposes,” Nixon says, “The same way that murderers and rapists get off.” Haldeman agrees. “The murderers and rapists have gotten off because of publicity, publicity, too much publicity,” Nixon continues. “I never agreed with it, but now that the court has spoken, that’s the law of the land. And if it’s good for a murderer, it’s good for a wiretapper.” Hilarity ensues. (Reeves 2001, pp. 517-518)
White House counsel John Dean reports that the Watergate grand jury will hand down seven indictments—the five Watergate burglars and their two handlers, E. Howard Hunt and G. Gordon Liddy (see September 15, 1972). It is good news in the Oval Office, as it seems the conspiracy investigation will end with these seven. Chief of staff H. R. Haldeman tells President Nixon: “Everybody’s satisfied [referring to the seven accused criminals]. They’re all out of jail, they’ve all been taken care of (see June 20-21, 1972). We’ve done a lot of discreet checking to be sure there’s no discontent in the ranks, and there isn’t any.” Nixon notes that Hunt’s “happiness” was bought at “considerable cost,” but says it is worth it. “That’s what the money’s for,” he says. “They have to be paid. That’s all there is to that.” (Reeves 2001, pp. 519-520)
US District Court Judge Charles Richey, presiding over the Democratic Party’s lawsuit against the Committee to Re-elect the President (see June 20, 1972), reverses his own ruling and orders all pre-trial statements and depositions to remain sealed until after the lawsuit has run its course. This ensures that court statements by Nixon campaign officials such as John Mitchell, Maurice Stans, and others will not be made public until after the November election. Richey makes the decision unilaterally; no motion for such a decision has been made by campaign lawyers. Richey explains his extraordinary decision by saying he is concerned for the constitutional rights of those involved in the lawsuit. After issuing the ruling, Richey himself calls Washington Post reporter Carl Bernstein to explain his decision. He tells Bernstein, “I want it to be very clear that I haven’t discussed this case outside the courtroom with anyone, and that political considerations played no part whatsoever.” Bernstein is astounded at the call; he has never met Richey, and had not contacted Richey for comment. (Bernstein and Woodward 1974, pp. 49) In November 1972, sources tell Post reporters Bernstein and Bob Woodward that “someone from the government got to Richey through the back door and got him to help the administration; a Republican governor said he could get to Richey and word came back that there was no need, it had already been done.” In their subsequent testimony, White House aides John Dean and H. R. Haldeman and Nixon campaign chairman John Mitchell all confirm that Richey was approached by Roemer McPhee, a close friend of Mitchell’s who, Dean will testify, pressured Richey into siding with the administration in the lawsuit. Richey will deny that McPhee tried to influence him. (Bernstein and Woodward 1974, pp. 206)
President Nixon responds to the report by the General Accounting Office (GAO) alleging possible illegal campaign finances in his re-election campaign (see August 22, 1972). Nixon tells reporters, “[W]e have a new law here in which technical violations have occurred and are occurring, apparently on both sides.” When asked what illegalities the Democrats have committed, Nixon says: “I think that will come out in the balance of this week. I will let the political people talk about, but I understand that there have been [violations] on both sides.” The financial director of his re-election campaign, Maurice Stans (see Before April 7, 1972), is an honest man, Nixon says, and is currently investigating the matter “very, very thoroughly, because he doesn’t want any evidence at all to be outstanding, indicating that we have not complied with the law.” Between the GAO’s and the FBI’s investigations, Stans’s own internal investigation, and an internal White House investigation by White House counsel John Dean, Nixon says there is no need for a special Watergate prosecutor, as some have requested. Of the Dean investigation: “I can say categorically that his investigation indicates that no one on the White House staff, no one in this administration, presently employed, was involved in this very bizarre incident [the Watergate burglary—see 2:30 a.m.June 17, 1972]. What really hurts in matters of this sort is not the fact that they occur, because overzealous people in campaigns do things that are wrong. What really hurts is if you try to cover it up.” (Bernstein and Woodward 1974, pp. 57; Gerald R. Ford Library and Museum 7/3/2007) A Washington Post story on the press conference highlights Nixon’s use of the phrase “presently employed,” and notes that several people suspected of campaign wrongdoing—G. Gordon Liddy, E. Howard Hunt, Maurice Stans, Hugh Sloan, and John Mitchell—no longer work for the administration. (Bernstein and Woodward 1974, pp. 57) An assistant attorney general is convinced that the Dean investigation is “a fraud, a pipeline to [White House aide H. R.] Haldeman.” (Bernstein and Woodward 1974, pp. 206) In April 1973, an associate of Dean tells Washington Post reporter Bob Woodward that there was never any such investigation, that Dean had not even discussed anything to do with Watergate as of August 29. “There never was a report,” the associate says. “Dean was asked to gather certain facts. The facts got twisted around to help some other people above him.” (Bernstein and Woodward 1974, pp. 297-298) Dean later tells Watergate investigators that he never conducted any such internal White House investigation (see June 3, 1973). Shortly after the Watergate indictments are handed down (see September 15, 1972), White House counsel John Dean is summoned to the Oval Office. He arrives to find President Nixon and chief of staff H. R. Haldeman “all grins,” as Dean will recall for his Watergate grand jury testimony. They are pleased the indictments have only gone as far as the seven burglars. “Great job, John,” Nixon tells Dean. “Bob told me what a great job you’re doing.” (Bernstein and Woodward 1974, pp. 312)
Nixon Encouraging Cover-up, Illegal Influence of Judge - According to Dean’s later testimony before the Senate Watergate Committee (see June 25-29, 1973), Nixon “told me that Bob had kept him posted on my handling of the Watergate case. The President told me I had done a good job and he appreciated how difficult a task it had been and the President was pleased that the case had stopped with Liddy.… I responded that I could not take credit because others had done much more difficult things than I had done.” Dean will say that he is thinking of senior campaign official Jeb Magruder, who had perjured himself to keep the Watergate grand jury from learning of higher involvement (see August 1972). “I also told him that there was a long way to go before this matter would end, and that I certainly could make no assurance that the day would not come when this matter would start to unravel.” Dean tells Nixon that there is a good chance to delay the Democrats’ civil suits against the Nixon campaign (see June 20, 1972) until after the election because campaign lawyers are talking out of court to the judge, Charles Richey, who is “very understanding and trying to accommodate their problems” (see August 22, 1972). Nixon says, “Well, that’s helpful.” If Dean’s testimony is accurate, Nixon is encouraging the cover-up of criminal activity, and is supportive of attempts to illegally influencing a judge in a civil suit. Nixon: Is Everyone Together 'to Stonewall?' - Nixon says he particularly enjoyed the burglars’ assertions to reporters that they would not inform on any superiors, and their memorized tirades about the Communist threat. He then asks, “Is the line pretty well set now on, when asked about the Watergate, as to what everybody says and does, to stonewall?” Haldeman responds that the burglars, particularly the four Cubans, “really believe” what they’re saying. “I mean, that was their motivation. They’re afraid of [Democratic candidate George] McGovern. They’re afraid he’ll sell out to the communists, which he will.” Dean predicts that “nothing will come crashing down” between now and the elections (see November 7, 1972). Nixon is already planning his post-election vengeance. “I want the most comprehensive notes on all those that tried to do us in,” he orders. “They are asking for it and they are going to get it…. We have not used the power in the first four years, as you know… but things are going to change now.” “That’s an exciting prospect,” Dean replies. (Reeves 2001, pp. 526-527)
The same afternoon that the Washington Post runs its article on the Nixon campaign’s “massive conspiracy” to disrupt the elections (see October 10, 1972), Nixon chief of staff H. R. Haldeman updates President Nixon of the situation with campaign “agent provocateur” Donald Segretti (see June 27, 1971, and Beyond). “Segretti, just so you know, is incommunicado,” Haldeman says. “But he calls [White House counsel] John Dean from a public phone and calls on a line that’s not traceable every day around noon. He’ll do anything. I’m told he was supposedly the ideal guy for this kind of thing. He’s a guy that loves this sort of college prank politics.” Nixon thinks Segretti should sue the Post: “I know he’ll lose it, but good God, in the public mind it creates an impression that they lied…. Right, Bob? You see the point? Sue the sons of b_tches.” (Reeves 2001, pp. 531-532)
President Nixon meets in his hideaway office in the Executive Office Building with his chief of staff, H. R. Haldeman. Their conversation is captured on Nixon’s secret taping system (see July 13-16, 1973). Haldeman reports that he has learned from his own secret source that there is a leak in the highest echelons of the FBI, a source apparently funnelling information to Washington Post reporters Bob Woodward and Carl Bernstein: “Mark Felt.” Felt, the deputy director of the bureau, is Woodward’s clandestine background source “Deep Throat” (see May 31, 2005). Haldeman warns Nixon not to say anything because it would reveal Haldeman’s source, apparently some “legal guy” at the Post. Besides, “[I]f we move on [Felt], he’ll go out and unload everything. He knows everything that’s to be known in the FBI.” According to White House counsel John Dean, there are no legal sanctions that can be taken against Felt, because Felt has broken no laws. Dean is worried that if the White House takes any action, Felt will “go out and get himself on network television.” Nixon snarls: “You know what I’ll do with him, the little b_stard. Well, that’s all I want to hear about it.” Haldeman tells Nixon that Felt wants to be director of the FBI. Nixon’s first question: “Is he Catholic?” “No sir, he’s Jewish,” Haldeman replies. “Christ, put a Jew in there?” Nixon asks. “Well, that could explain it too,” Haldeman observes. (Woodward 2005, pp. 85-86) Acting director L. Patrick Gray will inform Felt of the White House’s suspicions in early 1973, leading Felt to strenuously deny the charge, but Gray will refuse White House demands to fire Felt. (Woodward 2005, pp. 139)
White House secretary Kathleen Chenow (see June 28-July 3, 1972) confirms the existence of the “Plumbers,” the extralegal operation tasked with finding and closing media leaks (see Late June-July 1971). According to Chenow, the unit is made up of White House and Nixon campaign aides David Young, G. Gordon Liddy, E. Howard Hunt, and Egil Krogh. (O.T. Jacobson 7/5/1974 ) Chenow says that Nixon’s senior aide John Ehrlichman supervised the activities of the unit. She explains: “Originally the administration had wanted a study of how close the New York Times version of the Pentagon Papers (see March 1971) was to the actual documents. Then they tried to determine how the Pentagon Papers got out. That started it all, the business of looking for leaks. For a while, they were studying State Department leaks. They checked embassy cables and tried to put two and two together about whose desks the cables went across.” The “Plumbers” also investigated reporter Jack Anderson. Chenow says that when she was interviewed by the FBI in April, Young, White House counsel John Dean, and Dean’s aide Fred Fielding were present. She adds that when she subsequently testified before the Watergate grand jury, she was puzzled that prosecutor Earl Silbert never asked her about Ehrlichman. (Bernstein and Woodward 1974, pp. 215-217)
Acting FBI director L. Patrick Gray burns key documents in the Watergate case. He has had the documents, originally kept in the safe of Watergate burglar E. Howard Hunt, in his possession for about five months. The two Nixon aides who gave him the documents, John Ehrlichman and John Dean, warned Gray that they were “political dynamite” and should never see the light of day. Gray dithers over what to do with the documents for that entire time period before finally burning them with his Christmas trash. The documents include falsified diplomatic cables that implicated former President John F. Kennedy in the assassination of President Ngo Dinh Diem of South Vietnam, and a dossier on Democratic Senator Edward Kennedy’s troubled personal life. Gray will later tell investigators that he destroyed the papers because they had no relation to Watergate, and in 2005 will admit that he destroyed them on direct orders from White House officials. He will say that he had no idea “that these guys are trying to sandbag me,” and will add, “I know it’s hard for people to think somebody could be so stupid, but I believed them.” (Purdom 7/7/2005) Gray will reveal his destruction of evidence during the Watergate investigation (see April 27-30, 1973).
After the press reports that the Watergate burglars will receive cash payments in return for their guilty pleas and their silence (see January 8-9, 1973 and January 8-11, 1973), Judge John Sirica angrily grills the four Miami-based defendants in court about the claims. To a man, they deny any pressure to plead guilty, any knowledge of cash payments to themselves or their families, and any knowledge of discussions of possible executive clemency. Defendant Virgilio Gonzalez even denies being a former CIA agent, when evidence has already established that he was on a $100/month retainer by the agency until the day after the Watergate burglary. (Defendant G. Gordon Liddy laughs aloud when Gonzalez makes this claim.) Gonzalez claims that the entire Watergate operation was somehow involved with the Communist regime of Cuba: Gonzalez says he is committed to “protect[ing] this country against any Communist conspiracy.” Sirica rolls his eyes in disbelief. Gonzalez claims not to know any specifics of the supposed connection between the Democrats and Castro’s Cuba, and says that he trusted the judgement of his superiors, Liddy and E. Howard Hunt. Fellow defendant Bernard Barker claims that none of them were paid for their actions: “These are not men that sell themselves for money,” Barker states. Barker confirms that he worked for Hunt, and says it was an honor for him to perform such a service. Washington Post reporters Carl Bernstein and Bob Woodward later write, “The prosecutors’ assurances that everything would come out at the trial were fading into nothingness, as the defendants ducked into the haze of their guilty pleas.” The five who pled guilty are led off to jail before their bail and sentencing hearings. (Bernstein and Woodward 1974, pp. 233-235; Gerald R. Ford Library and Museum 7/3/2007) In his Watergate grand jury testimony, White House counsel John Dean will say that President Nixon approved executive clemency for Hunt in December 1972 (see January 10, 1973). (Bernstein and Woodward 1974, pp. 312) In 1974, Barker will write that while in jail, James McCord is their group leader, but they do not fully trust him, partly because he is “very friendly with Alfred Baldwin, and to us Baldwin was the first informer” (see May 29, 1972). Another disconnection between McCord and the Cubans is his lack of participation in the Ellsberg burglary (see September 9, 1971). (Martinez and Barker 10/1974)
During the Watergate trial of G. Gordon Liddy and James McCord (see January 30, 1973), Washington Post reporters Carl Bernstein and Bob Woodward begin poring over the exhibits and papers filed as evidence with the court. Woodward begins calling the phone numbers listed in the address books of the burglars (see June 18, 1972). He is told by one of the first people he calls: “The FBI? They never, never contacted me. I never talked to them.” Woodward is appalled that the FBI has made such a fundamental investigative failure of not calling all of the people listed in the books. (An FBI internal report will later attempt to explain the lapse—see July 5, 1974.)
Woodward Calls Witnesses - When the court releases the names of upcoming witnesses, Woodward begins calling them, too. He asks one witness, who knows burglar E. Howard Hunt (see January 8-9, 1973) very well, what he will testify to. “I’ll tell you what I could testify to, but [prosecutor Earl] Silbert won’t ask,” the witness replies. “If the judge does or any of the attorneys, I’ll say it.” The witness has already told everything he knows to Silbert and FBI investigators.
Ehrlichman Allegedly Ran Plumbers - He says that if asked, he would tell the court that, according to Hunt, White House aide John Ehrlichman was in charge of the Plumbers (see December 7, 1972). Hunt would have rather dealt with another White House aide, Charles Colson, “because Colson understood that such [secret intelligence gathering operations against political opponents] are necessary.” Ehrlichman was reluctant to implement some of Hunt’s schemes, the witness says, but Colson pushed them through. Former Nixon campaign chief John Mitchell received typed logs and reports of the wiretaps on the Democrats, the witness says.
Conspiracy Linked to Dean - Most surprisingly for Woodward, the witness says that when Hunt was in hiding from investigators (see June 18, 1972) and demanding a lawyer, he insisted that White House counsel John Dean find him one. This is the first time anyone has publicly connected Dean to the Watergate conspiracy.
Not Asked - As the witness predicts, he will not be asked any of this when he testifies. Woodward and Bernstein write a long analysis of the trial, headlined “Still Secret: Who Hired Spies and Why,” observing that the Liddy/McCord trial is notable for “questions that were not asked, answers that were not given, witnesses who were not called to testify, and some lapses of memory by those who were.” At the bond hearing for Liddy and McCord after the trial, Judge John Sirica will say that he hopes the proposed Senate investigation (see February 7, 1973) can find out what the trials did not. (Bernstein and Woodward 1974, pp. 237-241)
Four of President Nixon’s most trusted aides, H. R. Haldeman, John Ehrlichman, John Dean, and Richard Moore, meet at the La Costa Resort Hotel near Nixon’s home in San Clemente, California, to plan how to deal with the upcoming Senate Watergate Committee hearings (see February 7, 1973). The meetings are detailed in later testimony to the committee by Dean (see June 25-29, 1973). The group debates over which senators will be friends and which will be foes. Ehrlichman quips that Daniel Inouye (D-HI) should be called “Ain’t No Way” because “there ain’t no way he’s going to give us anything but problems.” Lowell Weicker (R-CT) is a Republican, but, says Dean, “an independent who could give the White House problems.” No one is sure which way co-chairman Howard Baker (R-TN) might go (see February 22, 1973). The only sure bet is Edward Gurney (R-FL), who one participant describes as “a sure friend and protector of the president’s interests” (see April 5, 1973). The aides decide to pretend to cooperate with the committee, but in reality, according to Dean’s testimony, “to restrain the investigation and make it as difficult as possible to get information and witnesses.” They discuss how to blame Democrats for similar, Watergate-like activities during their campaigns. Dean is taken aback when Haldeman suggests that the Nixon re-election campaign should “hire private investigators to dig out information on the Democrats.” Dean objects that such an action “would be more political surveillance.” But, he later testifies, “the matter was left unresolved.” (Time 7/9/1973)
President Nixon and his senior political aide, Charles Colson, discuss the Watergate conspiracy and how the White House should handle it. Nixon says, “A cover-up is the main ingredient.” Colson agrees, “That’s the problem.” Nixon continues: “That’s where we gotta cut our losses. My losses are to be cut. The president’s losses got to be cut on the cover-up deal.” Nixon will not admit to knowing anything about a cover-up until March 23, when he will claim to have been told for the first time about a cover-up by White House counsel John Dean (see March 21, 1973). Author James Reston Jr. calls this conversation, and that of the day before (see February 13, 1973), examples of Nixon and his aides’ “very good gangster talk,” and writes that “there could not be more classic evidence of the president wriggling, maneuvering, scheming to escape the reach of the law.” (Reston 2007, pp. 43-44) Nixon is not so worried about his former campaign chairman, John Mitchell. He “has a great stone face” and a “convenient memory,” he and Colson agree. Colson is fairly sure if burglar E. Howard Hunt begins talking to the Watergate prosecutors, he will “limit the losses,” but neither are fully convinced of Hunt’s commitment to silence. (Reston 2007, pp. 199-200)
Washington Post reporter Bob Woodward meets with W. Mark Felt, his secretive “Deep Throat” FBI source (see May 31, 2005), at an out-of-the-way bar in Maryland. During the meeting, Felt warns Woodward that the FBI is up in arms about finding the source, or sources, of news leaks about Watergate. The Nixon campaign lawsuit and subpoenas to Woodward and other reporters (see February 26, 1973) are “only the first step” in an all-out White House campaign against the press in general and the Post in particular. Felt says that Nixon has “told the appropriate people, ‘Go to any length’ to stop them. When he says that, he really means business.” There is about $5 million left in the Nixon campaign fund from the 1972 elections, and Nixon intends to use that money to, as Felt says, “take the Washington Post down a notch.” A full-blown grand jury investigation of the Watergate leaks is being planned, Felt says. Felt describes Nixon as “wild” and “shouting” about the idea. “He thinks the press is out to get him and therefore is disloyal; people who talk to the press are even worse—the enemies within, or something like that.” Felt seems surprisingly unconcerned, and explains that he feels the Nixon administration is, in Woodward’s words, “on the ropes.” “It can’t work. They’ll never get anyone. They never have. They’re hiding things that will come out and even discredit their war against leaks. They can’t stop the real story from coming out. That’s why they’re so desperate.… The flood is coming, I’m telling you.” Felt says that all of this is why L. Patrick Gray pressured the White House into naming him as permanent FBI director (see February 17, 1973), so he could help contain the leaks and ensure that the press never learns the true extent of Watergate. Felt also strongly implies that the Gray nomination is the result of implicit blackmail on Gray’s part—name him FBI director or, as Felt puts it, “all hell could break loose.” Gray and White House counsel John Dean will later deny this. (Bernstein and Woodward 1974, pp. 268-270; Woodward 2005, pp. 12-13)
White House counsel John Dean meets with President Nixon, who tells him that Watergate is taking up too much time from his top aides, H. R. Haldeman and John Ehrlichman. Henceforth, Dean can now stop reporting to them and report directly to Nixon. Dean finds Nixon’s rationale puzzling. According to Dean’s later testimony before the Senate Watergate Committee (see June 25-29, 1973), “He also told me that they were principals in the matter and I, therefore, could be more objective than they.” Dean isn’t sure what Nixon means by calling Haldeman and Ehrlichman “principals.” Dean later testifies that Nixon is adamant about never allowing either of the aides to “go to the Hill” and testify before the Senate. Instead, he says, he will protect them with a claim of executive privilege. At most, he says, the two aides will be allowed to respond to written questions. Dean tells Nixon that this “could be handled.” (Time 7/9/1973)

Watergate Conspiracy Could be Criminal, Dean Warns - According to his later testimony before the Senate Watergate Committee (see June 25-29, 1973), Dean warns Nixon of how serious the Watergate affair can become from a legal standpoint. “I told him that I thought he should know that I was also involved in the post-June 17 activities regarding Watergate,” Dean will testify. “I briefly described to him why I thought I had legal problems in that I had been a conduit for many of the decisions that were made and therefore could be involved in an obstruction of justice. He would not accept my analysis and did not want me to get into it in any detail.” If Dean’s testimony is accurate, Nixon has just been told by his lawyer that the Watergate cover-up could involve crimes, but brushes that aside. Hunt's Wife Carrying Burglar Payoffs - The conversation turns to the plane crash that killed the wife of Watergate burglar E. Howard Hunt (see December 8, 1972). Dean says that Dorothy Hunt was flying to (actually from) Chicago with $10,000 to give to “the Cubans,” referring to the Cuban burglars working under Hunt. Dean says, “You’ve got then, an awful lot of the principals involved who know. Some people’s wives know. Mrs. Hunt was the savviest woman in the world. She had the whole picture together,” possibly referring to Dorothy Hunt’s alleged threats to expose the entire Watergate conspiracy. Nixon, who knows the conversation is being taped, says of Dorothy Hunt’s death, “Great sadness. As a matter of fact there was discussion with somebody about Hunt’s problem on account of his wife and I said, of course commutation could be considered on the basis of his wife’s death, and that is the only conversation I ever had in that light.” Dean concurs: “Right. So that is it. That is the extent of the knowledge.” (Spartacus Schoolnet 8/2007)
The Senate confirmation hearings of FBI director L. Patrick Gray (see February 17, 1973) begin. (Woodward 2005, pp. 13-14) As predicted (see February 27, 1973), they are an opportunity for angry Democrats to grill Gray about the FBI’s failure to expand their investigation of the Watergate conspiracy beyond the burglary itself (see 2:30 a.m.June 17, 1972). Gray launches his testimony by insisting that the FBI conducted a “massive special” investigation, a “full-court press” with “no holds barred.” But on the first day of testimony, without even being asked, Gray volunteers that he had given White House Council John Dean some of the raw FBI files of the investigation (see June 28, 1972), and offers the senators the files to peruse for themselves. (Time 4/2/1973; Bernstein and Woodward 1974, pp. 272-273; O.T. Jacobson 7/5/1974 ) Gray admits to turning over at least 82 FBI documents on the investigation to Dean, even though the FBI’s general counsel had ordered that no documents be turned over without the approval of Attorney General Richard Kleindienst. In doing so, not only did Gray circumvent Kleindienst, whose Justice Department would have to prosecute anyone violating federal laws in the Watergate conspiracy, but gave information to White House officials bent on concealing evidence of their own involvement. Gray turns over a document showing that he spoke with Dean at least 33 times about the Watergate investigation between June and September 1972. (Time 4/2/1973; O.T. Jacobson 7/5/1974 ) After the second day of testimony, Washington Post reporter Carl Bernstein learns from Gray’s lawyer, William Bittman, that Dean had never given the FBI two notebooks from the safe of Watergate burglar E. Howard Hunt (see June 19, 1972). Bittman believes the notebooks contained information about who was involved in the Watergate conspiracy. Bittman, clearly disturbed by the missing documents, notes that they were “[v]aluable enough for someone to want them to disappear.” The Gray hearings will bring John Dean’s involvement in Watergate to the fore, and reveal that Gray took possession of the notebooks. William Sullivan, a high-ranking FBI official with decades of experience in conducting covert intelligence operations against anti-war and civil rights organizations and the chief of the FBI’s investigation into the assassinations of John F. Kennedy and Martin Luther King, Jr, writes a memo to White House counsel John Dean offering some advice on how the White House should handle the burgeoning Watergate investigation. Sullivan blasts the entire operation for “atrocious judgment” and a “lack of professionalism and competency.” He then turns to the problem of handling the Senate investigation (see February 7, 1973). There are three major elements in the Watergate conspiracy, Sullivan writes: “the breaking and entering of the [Watergate] building… the applications of technical surveillances… [and] the financing.” Sullivan observes that the financing “might turn out to be the most serious and harmful element in the problem.” Sullivan then turns to some of the details of the defense:
If the Senate investigation turns out to be a relatively limited and partisan probe, then the White House should, Sullivan counsels, sit back, deny everything, and wait for it to run its course. If the investigation is “real and exhaustive,” then “sitting tight” is “the wrong tactic.”
Sullivan recommends hiring a top-flight legal representative, preferably someone with a reputation for integrity and bipartisanship, and recommends having only “one or two men in high authority” working with that lawyer to ensure that the lawyer only hears what the White House wants him to hear. Another lawyer should be hired as an assistant, one who knows the Senate well and has experience in the Washington “jungle.”
When the Senate investigation launches its probe, press secretary Ron Ziegler should “issue a very clear, forceful and carefully constructed statement in representing the president, condemning again the Watergate activities and saying that he has instructed all concerned in the government to give their complete and willing cooperation to Senator Ervin and his colleagues.”
Sullivan writes that avoiding or downplaying specific issues would be a mistake. Instead, each issue should “be faced openly, briefly and without equivocation.” The investigation needs to be as brief as possible.
The overriding purpose of the Watergate defense should be to protect Richard Nixon and the Office of the President. “If worse comes to worse, bearing in mind the main objectives stated above, those involved in the Watergate affair should be considered expendable in the best interests of the country. Their culpability should be set forth in its entirety thereby directing the attention of the probers and the attention of the reading public away from the White House and to the men themselves where the blame belongs.”
Sullivan says that he knows little about the financial element of the Watergate conspiracy, but again warns of the potential damage it could cause. “[I]f it is as serious as I think it could be then those fully knowledgeable in this area should give the matter the most searching thought possible. Much more harm could be done here than in the area of the other two elements, namely breaking and entering and possessing and using electronic surveillance devices.” (Spartacus Schoolnet 8/2007; Spartacus Schoolnet 8/2007)
President Nixon says he will invoke “executive privilege” to prevent White House counsel John Dean from testifying at the confirmation hearings of FBI director L. Patrick Gray (see February 28-29, 1973). “No president could ever agree to allow the counsel to the president to go down and testify before a committee,” Nixon says. “I stand on the same position there that every president has stood on.” The Washington Post reports Nixon’s claim along with the news that Dean has apparently made two critical sets of Watergate documents disappear (see June 28, 1972). (Bernstein and Woodward 1974, pp. 273; Reeves 2001, pp. 574)
Acting FBI director L. Patrick Gray, mired in contentious Senate hearings about his nomination to permanently take the position (see February 28-29, 1973), says that contrary to media reports, White House counsel John Dean took nothing from the safe of Watergate burglar E. Howard Hunt. The White House issues a statement making the same claim. But Gray’s claims are critically undermined by another revelation. In FBI documents released to the Senate by Gray as part of his testimony, and subsequently made available to the public, one document catches the eye of reporters: a memo titled “Interview with Herbert W. Kalmbach.” Kalmbach, President Nixon’s personal lawyer, said in the interview that in August or September 1971, he had obeyed instructions from Nixon aide Dwight Chapin to hire Nixon campaign operator Donald Segretti (see June 27, 1971, and Beyond) and pay Segretti for his services. The interview guts the White House’s claim that it never hired any such agents provacateurs as Segretti, destroys Gray’s (and the FBI’s) credibility with many senators, and vindicates the media’s reporting on the broader Watergate conspiracy. The atmosphere at the Washington Post is jubilant. Post reporters Carl Bernstein and Bob Woodward put together a scathing news analysis based on the discovery, using quote after quote from administration sources and pairing each quote with information disproving the administration claims. Unfortunately, the reporters later write, the article is unintentionally “packaged like an ax murder,” with a row of pictures of Nixon officials that resemble a lineup of mug shots. White House officials later tell the reporters that this single story garners a tremendous amount of hatred and resentment among Nixon officials. (Bernstein and Woodward 1974, pp. 273-274; Woodward 2005, pp. 13-14)
According to his later testimony before the Senate Watergate Committee (see June 25-29, 1973), White House counsel John Dean talks for the first time to President Nixon about the payment of “hush money” to the seven Watergate defendants (see June 20-21, 1972 and March 21, 1973). With Nixon’s top aide, H. R. Haldeman, present, Dean, according to his testimony, “told the president that there was no money to pay these individuals to meet their demands. He asked me how much it would cost. I told him that I could only estimate, that it might be as high as a million dollars or more. He told me that that was no problem and he also looked over at Haldeman and repeated the statement. He then asked me who was demanding this money, and I told him it was principally coming from [Watergate burglar E. Howard] Hunt through his attorney.” Nixon then reminds Dean that Hunt has been promised executive clemency (see January 8-9, 1973). Though Nixon will deny any knowledge of either payoffs or executive clemency, if Dean’s testimony is true, Nixon could well be guilty of obstruction of justice. The White House will also claim that this topic first comes up on March 21 rather than today (see March 21, 1973). (Time 7/9/1973)
Convicted Watergate burglar James McCord (see January 30, 1973) writes a letter to the presiding judge, John Sirica, in response to Sirica’s requests for more information. McCord writes that he is “whipsawed in a variety of legalities”—he may be forced to testify to the Senate (see February 7, 1973), and he may be involved in future civil and other criminal proceedings. He also fears unspecified “retaliatory measures… against me, my family, and my friends should I disclose” his knowledge of the Watergate conspiracy. But McCord wants some leniency from Sirica in sentencing. McCord alleges that the five defendants who pled guilty did so under duress. The defendants committed perjury, McCord continues, and says that others are involved in the burglary. The burglary is definitely not a CIA operation, though “[t]he Cubans may have been misled” into thinking so. McCord writes, “I know for a fact that it was not,” implying inside knowledge of at least some CIA workings. McCord requests to speak with Sirica privately in the judge’s chambers, because he “cannot feel confident in talking with an FBI agent, in testifying before a Grand Jury whose US attorneys work for the Department of Justice, or in talking with other government representatives.” In his discussion with Sirica, he makes the most explosive charge of all: he and his fellow defendants lied at the behest of former Attorney General John Mitchell, now the head of the Nixon re-election campaign, and current White House counsel John Dean. (Bernstein and Woodward 1974, pp. 275-276; Time 1/7/1974; James W. McCord, Jr 7/3/2007; Gerald R. Ford Library and Museum 7/3/2007) It seems that McCord writes his letter to Sirica in retaliation for President Nixon’s firing of CIA director Richard Helms, and the White House’s attempts to pin the blame for the Watergate conspiracy on the CIA (see December 21, 1972).
In his conversation with chief of staff H. R. Haldeman about White House counsel John Dean’s phony “Dean Report,” which will say that no one in the White House was involved in the Watergate conspiracy (see March 22, 1973), President Nixon says: “[The report] should lay a few things to rest. I didn’t do this, I didn’t do that, da-da, da-da, da-da, da-da, da-da, da-da, da-da. Haldeman didn’t do this. Ehrlichman didn’t do that. Colson didn’t do that. See?” (Reston 2007, pp. 42-43)
White House counsel John Dean warns President Nixon of a “cancer on the presidency.” When this phrase enters the public dialogue, it is popularly misremembered as Dean warning Nixon about the ill effects of the Watergate conspiracy on the Nixon presidency. Instead, Dean is warning Nixon about the deleterious effects of the blackmail efforts being carried out against the White House by the convicted Watergate burglars (see June 20-21, 1972). In a conversation secretly taped by Nixon, Dean says, “We have a cancer within, close to the Presidency, that is growing. Basically it is because we are being blackmailed.” (Reeves 2001, pp. 577-578; Gerald R. Ford Library and Museum 7/3/2007; Spartacus Schoolnet 8/2007)
Cancer Should 'Be Removed Immediately' - In later testimony to the Senate Watergate Investigative Committee (see June 25-29, 1973), Dean states his words somewhat differently: “I began by telling the president that there was a cancer growing on the presidency and that if the cancer was not removed, that the president himself would be killed by it. I also told him that it was important that this cancer be removed immediately because it was growing more deadly every day.” Dean then tells Nixon virtually the entire story of the Watergate conspiracy, noting his discussions with other conspirators about the prospective wiretapping of the Democrats—particularly Watergate burglar G. Gordon Liddy and campaign officials John Mitchell and Jeb Magruder—and tells Nixon that he had reported the plans to Nixon’s top aide, H. R. Haldeman. He had participated in paying off the burglars to remain silent, and had coached Magruder to perjure himself before the Watergat grand jury (see April 14-18, 1973). Dean will testify: “I concluded by saying that it is going to take continued perjury and continued support of these individuals to perpetuate the cover-up and that I did not believe that it was possible to so continue it. Rather, all those involved must stand up and account for themselves and the president himself must get out in front.” But, Dean will testify, Nixon refuses to countenance Dean’s advice, and instead sets up a meeting with Dean, Haldeman, Mitchell, and his other top aide, John Ehrlichman. Nixon hopes that Mitchell will agree to take the blame for the Watergate wiretapping, and thusly quell the public uproar (Mitchell will refuse). Nixon, Haldeman, Ehrlichman, and Dean meet a second time that afternoon, a meeting which Dean will later describe as another “tremendous disappointment.” He will testify, “It was quite clear that the cover-up as far as the White House was concerned was going to continue.” He will testify that he believes both Haldeman and Ehrlichman, and himself, are indictable for obstruction of justice, and that “it was time that everybody start thinking about telling the truth.” However, both aides “were very unhappy with my comments.” (Time 7/9/1973) Dean tells Nixon that to save his presidency, he and his closest aides Haldeman and Ehrlichman are going to have to testify and most likely go to jail. (Bernstein and Woodward 1974, pp. 304)
Blackmail Payoffs - Between the blackmail and the almost-certainty that White House officials are going to start perjuring themselves, Dean concludes that the problem is critical. Convicted burglar E. Howard Hunt wants another $72,000 for what he is calling personal expenses and $50,000 more for attorneys’ fees. Hunt directly threatened aides John Ehrlichman and Egil Krogh (see July 20, 1971) with his testimony, saying that, Dean reports, “I have done enough seamy things for he and Krogh that they’ll never survive it.” Hunt is threatening to reveal the story behind the Ellsberg break-in (see September 9, 1971) and, in Dean’s words, “other things. I don’t know the full extent of it.” Nixon asks, “How much money do you need?” Dean replies, “I would say these people are going to cost a million dollars over the next two years.” Nixon muses, “You could get a million dollars. You could get it in cash. I know where it could be gotten. I mean it’s not easy but it could be done.” The money can be raised, Nixon says, but the idea of any presidential pardons for anyone is out. Nixon learns from his secretary, Rose Mary Woods, that their secret campaign fund still has over $100,000. That evening, Hunt is given $75,000 in cash. (Reeves 2001, pp. 577-578; Gerald R. Ford Library and Museum 7/3/2007; Spartacus Schoolnet 8/2007) Hunt will eventually receive $120,000, almost the exact amount he demands. (Reston 2007, pp. 35)
The Senate hearings for L. Patrick Gray’s nomination as FBI director (see February 28-29, 1973) become ever more contentious after revelations that the White House lied about its employment of campaign operatives like Donald Segretti (see March 6-7, 1973). Gray testifies that White House counsel John Dean “probably” lied when he told FBI investigators he did not know Watergate burglar E. Howard Hunt worked in the White House (see 2:30 a.m.June 17, 1972), even though the FBI’s investigation showed that Dean originally hired another of the burglary plotters, G. Gordon Liddy. (Time 4/2/1973; Bernstein and Woodward 1974, pp. 274; Woodward 2005, pp. 13-14)
President Nixon tells his aides, in a secretly recorded conversation (see July 13-16, 1973), to ensure that the nation never learns of the political and financial machinations that surround the Watergate burglary from his aides under investigation: “And, uh, for that reason, I am perfectly willing to—I don’t give a sh_t what happens, I want you all to stonewall it, let them plead the Fifth Amendment, cover-up or anything else.” Judge John Sirica, presiding over the Watergate trials, is appalled at later hearing this conversation. Sirica will later write, “A lifetime of dealing with the criminal law, of watching a parade of people who had robbed, stolen, killed, raped, and deceived others, had not hardened me enough to hear with equanimity the low political scheming that was played back to me from the White House offices.” (Werth 2006, pp. 131-132) Nixon tells aides H. R. Haldeman and John Ehrlichman that E. Howard Hunt, who has been blackmailing the White House (see March 21, 1973), is no longer a problem. But he wants something on paper that he can point to and say he knew nothing about the Watergate conspiracy, and that he had ordered an internal investigation of the matter. He sends counsel John Dean to Camp David for the weekend to write the document. (Reeves 2001, pp. 578-579)
Senate Watergate counsel Samuel Dash tells reporters that, following the extraordinary letter from convicted Watergate burglar James McCord that alleged perjury and enforced silence in the trial of the burglars (see March 19-23, 1973), he has twice interviewed McCord. McCord has “named names” and begun “supplying a full and honest account” of the Watergate operation. He refuses to give details, but promises that McCord will soon testify in public Senate hearings. Shortly after the press conference, the Los Angeles Times reports that McCord named White House counsel John Dean and Nixon campaign deputy director Jeb Magruder as two of the Nixon officials involved in planning the Watergate surveillance operation. Dean has not been named as being involved in the Watergate planning until now. The White House denies Dean’s involvement; significantly, its statement does not mention Magruder—the Nixon administration has cut him loose. Three Capitol Hill sources confirm the story; one Republican politician anonymously tells the Post that McCord’s allegations are “convincing, disturbing, and supported by some documentation.” Dean’s lawyer learns of a planned follow-up story by the Washington Post and threatens to sue the Post if it prints the allegations; Post editor Howard Simons orders that the story be published, including the threat from Dean’s lawyer. (Bernstein and Woodward 1974, pp. 276-277)
President Nixon spends almost his entire workday on the Watergate case. He orders senior aide John Ehrlichman to conduct his own “independent investigation” of the conspiracy, since White House counsel John Dean has not yet produced the results of his own “investigation” (see March 22, 1973). During the course of the day, Secretary of State William Rogers, who is not in the Watergate loop, tells chief of staff H. R. Haldeman he does not believe the White House denials: “Why did we get into the cover-up if we don’t know what the real story is to begin with?… The attempts to cover up make the basic alibi of noninvolvement of the White House inconceivable.” Nixon reassures Rogers that the denials are true, and pins the blame on former campaign chief John Mitchell and deputy chief Jeb Magruder. (Reeves 2001, pp. 580-581)
Acting FBI director L. Patrick Gray, writhing under harsh questioning in his Senate confirmation hearings (see February 28-29, 1973), has displayed a candor and a willingness to reveal information that the White House has found disturbing. But that comes to an end; after Gray’s early offer to let senators examine the FBI’s files on the Watergate investigations, Attorney General Richard Kleindienst overrules that offer. Kleindienst insists that Gray has no authority to make such an offer, and instead proposes that only the chairman of the Judiciary Commiteee, James Eastland (D-MS), and its ranking member Roman Hruska (R-NE), be allowed to view the files. Gray is privately ordered by Kleindienst to stop talking about the FBI investigation. Gray reluctantly obeys, and begins responding to questions about the investigation by saying, “I respectfully decline to answer that question.” Towards the end of the hearings, Gray will inform the committee about Kleindienst’s “gag order.” Kleindienst may have issued the order because of Gray’s testimony that he was pressured by White House aides John Dean and John Ehrlichman to find and close media leaks they believed were coming from within the FBI, requests that Gray resented “because I don’t think there were those leaks within the FBI.” (Time 4/2/1973; O.T. Gray's Partisanship Questioned - Committee members also question Gray’s open advocacy of the Nixon administration, a position they find unbecoming in a supposedly nonpartisan FBI director. They want to know why in September 1972 he abandoned the agency’s nonpartisan tradition and ordered 21 field offices to file expert advice on how best Nixon and his aides could handle campaign issues related to criminal justice. And they are disturbed that during the 1972 campaign, Gray himself stumped for Nixon in three separate speeches, in what Time magazine calls “blatantly political activity his predecessor [J. Edgar Hoover] would never have undertaken.” Committee member Robert Byrd (D-WV) said before the hearings: “In the nine months that Mr. Gray has held the post of acting director, there has been increasing criticism of that bureau as becoming more and more a political arm of the administration. Under J. Edgar Hoover, the FBI had always been a nonpolitical bureau, and Mr. Hoover meticulously avoided partisanship in campaigns.” Confirmation of Gray, Byrd continued, “would be damaging to the proficiency and morale of the agency.” Many senators also question Gray’s lack of law enforcement experience. 'Twist[ing] in the Wind' - During the hearings, Nixon aide John Ehrlichman privately proposes that the White House not support Gray, and instead leave him to “twist slowly, slowly in the wind” until he resigns (see April 5, 1973). Shortly before his death in 2005, Gray will say, “I made the gravest mistake of my 88 years” in going to work for Nixon. “I put the rudder in the wrong direction.” (Purdom 7/7/2005)
White House counsel John Dean begins cooperating with the Watergate prosecutors. (Gerald R. Ford Library and Museum 7/3/2007) Dean has already been asked to resign and has refused, fearing that President Nixon and his top aides will try to pin the blame for Watergate on him. Shortly after agreeing to cooperate with the investigation, Dean issues a statement making it clear that he is unwilling to be a “scapegoat in the Watergate case.” (Spartacus Schoolnet 8/2007) According to an associate of Dean’s, when Dean told Nixon that he and aides H. R. Haldeman and John Ehrlichman would have to go to jail to protect the presidency (see March 21, 1973), Nixon seemed resigned to the possibility. But shortly thereafter, Haldeman and Ehrlichman convinced Nixon that Dean could be the “fall guy” for the entire White House. “Instead of agreeing to cooperate, they are still telling [Nixon] that John should walk the plank for all of them. [Nixon] is ready to give John the final shove.” A Nixon campaign official will verify the Dean associate’s account, and say that Dean wanted to be honest, but was following orders from Haldeman and Ehrlichman. (Bernstein and Woodward 1974, pp. 305) Dean will soon begin sharing evidence that implicates Haldeman and Ehrlichman in the Watergate conspiracy (see June 25-29, 1973). (Stern and Johnson 5/1/1973)
White House counsel John Dean tells top Nixon aide H. R. Haldeman that he intends to testify about his knowledge of the Watergate conspiracy (see March 21, 1973). Haldeman advises against it, saying, “Once the toothpaste is out of the tube, it’s going to be very hard to get it back in.” Dean compiles a list of 15 names of White House and Nixon campaign officials he believes could be indicted for crimes in the Watergate conspiracy (ten of those names are lawyers). He shows the list to fellow Nixon aide John Ehrlichman. (Time 7/9/1973)
White House aide John Ehrlichman presents the results of his “independent investigation” of Watergate (see March 27, 1973) to President Nixon and chief of staff H. R. Haldeman. Ehrlichman is candid in his assessment, telling Nixon that he “can’t just sit here.… You’ve got to make some decisions.” Of the “hush money” paid out to the burglars, Ehrlichman says: “There were eight or ten people around here who knew about this, knew it was going on. Bob knew, I knew, all kinds of people knew—” Nixon interrupts to say, “Well, I knew it.” Ehrlichman’s report, seven handwritten pages, is essentially accurate, though it slants the facts away from the criminality of the Watergate conspiracy and fixes the bulk of the blame on convicted conspirators E. Howard Hunt and G. Gordon Liddy, along with former campaign chief John Mitchell, Mitchell’s then-deputy Jeb Magruder, and White House counsel John Dean. The only involvement of Haldeman and Ehrlichman in Ehrlichman’s version of events is as knowledgeable onlookers; Nixon is not mentioned at all. The memo warns that many lower-level participants, including Dean, Hunt, and Magruder, are either talking to investigators or preparing to talk. Nixon tells Ehrlichman to inform Mitchell that he has to take the blame in his upcoming testimony. Ehrlichman has Mitchell fly to Washington to hear Nixon’s proposal, but Mitchell refuses to take the entire fall. “He’s an innocent man in his heart and in his mind and he does not intend to move off that position,” Ehrlichman reports. In essence, Dean, Magruder, and Mitchell each intend to fix the blame on one another and dodge the blame for themselves, Ehrlichman concludes. (Reeves 2001, pp. 585-586)
Former CREEP deputy director Jeb Magruder testifies in private to investigators for the Watergate investigation. Washington Post reporter Bob Woodward learns of Magruder’s testimony on April 18, from a CREEP official. The official tells Woodward that “Magruder is your next McCord (see March 28, 1973). He went to the prosecutors last Saturday [April 14] and really tucked it to [John] Dean and [John] Mitchell.” Woodward asks why Magruder, who has a reputation for extreme loyalty, would testify against anyone in either the White House or the campaign. “Bad sh_t, man,” the official responds. “The walls were coming in on him—walls, ceiling, floor, everything.” Magruder blamed Dean and Mitchell for “[t]he whole mess,” says the official, “the bugging plans and the payoff scheme… those meetings, or at least one meeting, in Mitchell’s office when everything was discussed with [G. Gordon] Liddy before the bugging.” Woodward confirms the official’s account with a White House official, who says that Magruder told everything he knew: “The works—all the plans for the bugging, the charts, the payoffs.… This is no hearsay like McCord. It will put Dean and Mitchell in jail.” Magruder’s lawyer confirms that his client will testify before the grand jury when called. And a Justice Department official adds that “other people will testify that Mitchell and Dean were in on the arrangements for the payoffs.” (Bernstein and Woodward 1974, pp. 292-293) The same day, Magruder admits to Bart Porter, the campaign’s director of scheduling, that he has been using Porter to help cover his own involvement in the Watergate conspiracy (see July 31, 1972). Porter, who has lied three times under oath for Magruder (see January 8-11, 1973), is horrified. He decides to stop lying for Magruder or anyone else, and tell the Senate Watergate Committee everything he knows about Watergate, regardless of the consequences. (Porter 10/1974)
White House counsel John Dean meets with President Nixon to discuss his upcoming testimony before the Watergate grand jury (see April 6-20, 1973). Dean apologizes for not telling Nixon himself (Nixon had learned of Dean’s intent to testify from the Justice Department—see April 6-20, 1973). Dean agrees not to talk about “national security” matters such as the indiscriminate wiretapping the White House has had the FBI perform. Nixon also says that “he had, of course, only been joking” when he the remark he made earlier to Dean about being able to provide $1 million in “hush money” to the Watergate burglars (see March 21, 1973). According to later testimony by Dean (see June 25-29, 1973), during the meeting, Nixon “went behind his chair to the corner of the office and in a nearly inaudible tone said to me he was probably foolish to have discussed Hunt’s clemency with Colson” (see March 21, 1973). Dean concludes by saying that he hopes nothing he’s done will “result in the impeachment of the President.” According to Dean’s testimony, Nixon replies jokingly, “I certainly hope so also.” Both men are stilted and formal; Nixon knows he is being tape-recorded for posterity (see July 13-16, 1973), and Dean suspects the taping. The White House will contend that Dean’s version of events is wrong, and that Nixon tells Dean he has to testify without immunity. The audiotapes later show that Dean’s version of events is accurate. (Time 7/9/1973; Reeves 2001, pp. 587-588)
White House counsel John Dean tells President Nixon that he and senior aides H. R. Haldeman and John Ehrlichman should resign in an attempt to protect Nixon from the Watergate fallout. Nixon concurs; in fact, he has already had two letters of resignation drawn up for Dean to sign. One reads, “In view of my increasing involvement in the Watergate matter, my impending appearance before the grand jury and the probability of its action, I request an immediate and indefinite leave of absence from my position on your staff.” The other is similarly worded, but tenders Dean’s resignation. Dean balks at signing them, and asks to rewrite and resubmit them. Nixon continues trying to rewrite his earlier exchanges with Dean, hoping to shape Dean’s testimony about Nixon’s earlier assertions of executive privilege and the payout of “hush money” to the convicted burglars (see April 15, 1973). Dean attempts to take credit for attempting to stop the Watergate conspiracy in its inception, but Nixon wants Dean’s testimony to credit him and not Dean. He even wants Dean to testify that the case was broken because of Nixon’s actions. After Dean leaves, Nixon, Haldeman, and Ehrlichman discuss the way they want the Watergate story to be told, deflecting and minimizing their own roles in the conspiracy and crediting themselves for bringing the story to light. Dean later returns with a written request for an indefinite leave of absence that says nothing about his Watergate involvement. Nixon wants to fire Dean and retain Haldeman and Ehrlichman, but knows that will send Dean into a spate of testimony that will drag everyone, including Nixon, down. “There’s no sense in aggravating Dean,” Nixon says. “He’ll do anything to save his own ass. He’s pissing as high as he can get now. We can’t let him piss any higher” and implicate Nixon. (Reeves 2001, pp. 588-590)
After learning that the White House will soon make a dramatic Watergate admission, Washington Post reporter Bob Woodward meets clandestinely with his “Deep Throat” source, FBI deputy director W. Mark Felt (see May 31, 2005). Felt drops a bombshell. “You’d better hang on for this,” he says. “Dean and Haldeman are out—for sure” (see April 30, 1973). John Dean is President Nixon’s White House counsel and one of the key figures in the Watergate conspiracy. H. R. Haldeman is Nixon’s chief of staff and closest confidante. “Out. They’ll resign. There’s no way the president can avoid it.” Woodward and his colleague Carl Bernstein inform Post editor Ben Bradlee of Felt’s revelation (avoiding any identification of Felt). Bradlee is reluctant to print such an explosive story based on one “deep background” source, no matter how reliable. The story does not go to print. (Woodward 2005, pp. 75-81) Felt’s story is accurate as far as it goes. The day before, Attorney General Richard Kleindienst had informed President Nixon that Dean and former campaign deputy Jeb Magruder testified, and that they named Haldeman, White House aide John Ehrlichman, and former campaign chief John Mitchell as co-conspirators. Dean went even further, demanding complete immunity and threatening to implicate Nixon if he was not given legal protection. Kleindienst says he will have to recuse himself from further involvement in the investigation because of his close relationship with Mitchell (see April 19, 1973), but deputy attorney general Henry Peterson will keep Nixon informed of any and all events that transpire. (Reeves 2001, pp. 586-587) It is not clear if Felt knew that Mitchell and Ehrlichman had also been implicated; in any event, he does not inform Woodward. (Woodward 2005, pp. 75-81)
The Washington Post reports that testimony from former Committee to Re-elect the President (CREEP) director Jeb Magruder (see April 14-18, 1973) shows that White House counsel John Dean and former CREEP director John Mitchell “approved and helped plan the Watergate bugging operation,” and that “Mitchell and Dean later arranged to buy the silence of the seven convicted Watergate conspirators.” A simultaneous piece by the New York Times reports that Attorney General Richard Kleindienst has recused himself from handling the case because of “persistent reports” that three or more of his colleagues will be indicted (see April 16-17, 1973). The Watergate grand jury is shifting its focus from the Watergate bugging itself to the issue of the cover-up and the possibility of obstruction of justice by administration officials. If indicted, the story says, Dean will cooperate with the investigation. Dean’s office issues a statement from Dean that says although he will continue to refrain from making public comments on the case, that policy may change. “[S]ome may hope or think that I will become a scapegoat in the Watergate case. Anyone who believes this does not know me, does not know the true facts, nor understand our system of justice.” A friend of Dean’s confirms Dean’s new defiance, saying: “John welcomes the opportunity to tell his side of the story to the grand jury. He’s not going to go down in flames for the activities of others.” (Bernstein and Woodward 1974, pp. 293-296)
While vacationing in Florida (see April 22, 1973), President Nixon tells White House counsel John Dean to go to Camp David and begin preparing an internal report on Watergate that will exonerate White House officials from any allegations of wrongdoing. Although Dean has no intention of producing such a report, instead intending to testify against Nixon and the White House (see April 24, 1973), he tells Nixon he will produce the report. (Gerald R. Vacationing in his Key Biscayne, Florida home, President Nixon calls chief of staff H. R. Haldeman and senior aide John Ehrlichman. He tells Haldeman: “You’re doing the right thing [by resigning—see April 16-17, 1973 and April 30, 1973]. That’s what I used to think when I killed some innocent children in Hanoi.” He also speaks to White House counsel John Dean. Dean will later say that Nixon tells him, “You’re still my counsel.” (Reeves 2001, pp. 594)
Attorney General Richard Kleindienst meets with President Nixon to tell him that White House counsel John Dean has testified about the White House’s ordering of the Ellsberg break-in (see September 9, 1971). The biggest problem is not the ties to the Watergate burglary, Kleindienst says, but the trial of Daniel Ellsberg now going on in Santa Monica, California (see May 11, 1973). The prosecution must inform the trial judge about the new information, and the judge must decide whether to inform Ellsberg’s lawyers. Nixon tries to claim that the break-in is a matter of national security and must not be divulged, but Kleindienst says it is too late for that, the information will “be out in the street tomorrow or two days from now, a week, and the law clearly dictates that we have to do—it could be another g_ddamn cover-up, you know.… We can’t have another cover-up, Mr. President.” Nixon says, “I don’t want any cover-ups of anything.”
Motive - Dean’s primary motive for divulging this information is his desire for immunity from prosecution, Kleindienst believes. He adds that Deputy Attorney General Henry Peterson has asked about granting Dean immunity: “and he even comes up to the point where a trump card of Dean would be that I’m going to implicate the president—and I told Henry at that point you have to tell Dean to go f_ck himself. You’re not going to blackmail the government of the United States and implicate the president in the Ellsberg matter.” Nixon, depressed and reckless, says that maybe he should just be impeached and removed from office, letting Vice President Spiro Agnew have the presidency. “There’s not going to be anything like that,” Kleindienst assures Nixon.
Details of Testimony - Nixon also grills Peterson about Dean’s testimony, and learns that Dean has divulged his knowledge of the destruction of key evidence by FBI chief L. Patrick Gray (see Late December 1972 and April 27-30, 1973)—Gray denies destroying the evidence, claiming Dean is lying. Nixon says Gray has to resign. Peterson says he will not give in to Dean on any attempt to blackmail his way into an immunity agreement; Nixon agrees, comparing it to the stories of paying Watergate burglar E. Howard Hunt “hush money” (see June 20-21, 1972)—“I would never approve the payoff of Hunt,” Nixon assures Peterson. Nixon ends the conversation by asking Peterson for the details of any upcoming case against chief of staff H. R. Haldeman. Peterson agrees to give him that information. (Reeves 2001, pp. 595-598)
The New York Daily News reports that acting FBI director L. Patrick Gray destroyed potentially incriminating evidence taken from the safe of Watergate burglar E. Howard Hunt (see Late December 1972). Gray, who testified to this days before to the Watergate grand jury, said that he received the material from White House counsel John Dean. “I said early in the game,” Gray testifies, “that Watergate would be a spreading stain that would tarnish everyone with whom it came in contact—and I’m no exception.” Shortly afterwards, Washington Post reporter Bob Woodward learns from his “Deep Throat” source, FBI deputy director W. Mark Felt (see May 31, 2005), that the story is true. Felt informs Woodward that Gray was told by Nixon aides Dean and John Ehrlichman that the files were “political dynamite” that could do more damage to the Nixon administration than Watergate (see June 28, 1972). Woodward realizes that the story means Gray’s career at the FBI is finished. Woodward and his colleague Carl Bernstein write their own report for April 30; the same day, Gray resigns from the FBI (see April 5, 1973). Instead of Felt being named FBI director, as he had hoped, Nixon appoints the head of the Environmental Protection Agency, William Ruckelshaus, to head the bureau. Felt is keenly disappointed. (Time 8/20/1973; O.T. Jacobson 7/5/1974 ; Woodward 2005, pp. 96-98) When he learns of Gray’s actions, Post editor Howard Simons muses: “A director of the FBI destroying evidence? I never thought it could happen.” (Bernstein and Woodward 1974, pp. 306-307) The FBI’s 1974 report on its Watergate investigation dates Gray’s resignation as April 27, not April 29 (O.T. Jacobson 7/5/1974 ) , a date supported by reports from Time. (Time 8/20/1973)
Washington Post reporter Bob Woodward interviews a senior presidential aide to talk about the explosive testimony of White House counsel John Dean (see April 6-20, 1973 and April 24, 1973). The aide says that Dean will implicate Richard Nixon in the Watergate cover-up. “I’m not sure” what Dean has, the aide says. “I’m not sure it is evidence.” The aide is visibly upset. “The president’s lawyer is going to say that the president is… well, a felon.” He asks Woodward to leave. (Bernstein and Woodward 1974, pp. 308)
President Nixon announces that his closest senior aides, H. R. Haldeman and John Ehrlichman, have resigned (see April 30, 1973). Attorney General Richard Kleindienst also resigns, to be replaced by Elliot Richardson; White House counsel John Dean, who is cooperating with Congressional investigators (see April 6-20, 1973), is also said to resign, although actually he was fired. Nixon makes his announcements on prime-time television; he tells his listeners that he wants to speak “from my heart.”
Knew Nothing Until He Watched the News - Nixon claims that he knew nothing of the so-called “Watergate affair” until he learned of the Watergate burglary (see June 17, 1972) from news reports. He describes himself as “appalled at this senseless, illegal action,” and “shocked to learn that employees of the Re-Election Committee [Committee to Re-elect the President, or CREEP)] were apparently among those guilty. I immediately ordered an investigation by appropriate government authorities.” Nixon says that he asked those authorities on several occasions “[I]f there was any reason to believe that members of my administration were in any way involved. I received repeated assurances that there were not. Because of these continuing reassurances, because I believed the reports I was getting, because I had faith in the persons from whom I was getting them, I discounted the stories in the press that appeared to implicate members of my administration or other officials of the campaign committee.”
'Personally Assumed Responsibility' for Inquiries, Demanded Cooperation - Nixon goes on to say that he believed the denials until March 1973, and the denials and comments he made were not intended to mislead, but merely “based on the information provided to us at the time we made those comments.” He then learned that “there was a real possibility that some of these charges were true, and suggesting further that there had been an effort to conceal the facts both from the public, from you, and from me.” On March 21, Nixon says, “I personally assumed the responsibility for coordinating intensive new inquiries into the matter, and I personally ordered those conducting the investigations to get all the facts and to report them directly to me, right here in this office.” Nixon says that he ordered everyone in government and at CREEP to fully cooperate with the investigators, the prosecutors, and the grand jury looking into the matter. Although insisting on “ground rules… that would preserve the basic constitutional separation of powers between the Congress and the presidency,” he “directed” members of his staff to testify under oath to the Senate Watergate Committee. The “integrity of this office” must “take priority over all personal considerations.”
Concerns with Ethics, Integrity Impelled Resignations - It is this concern for the integrity of the presidency, and his commitment to the most “rigorous legal and ethical standards,” that moved Nixon to accept the resignations of Haldeman and Ehrlichman, which he hastens to note do not imply any “implication whatever of personal wrongdoing on their part.” He asked Kleindienst to resign, not because of any implication of wrongdoing, but because of his “close personal and professional [association with] some of those who are involved in this case.” He has given Kleindienst’s successor, Richardson, the authority to name a special prosecutor to take over the investigation if Richardson deems it necessary. Nixon says: “[J]ustice will be pursued fairly, fully, and impartially, no matter who is involved. This office is a sacred trust and I am determined to be worthy of that trust.”
Shifting the Blame - Nixon says that until 1972, he had personally run his own political campaigns. But he was too busy with “crucially important decisions… intense negotiations [and] vital new directions” for the nation; he decided “the presidency should come first and politics second.” He therefore delegated as much of his campaign’s operations to others, and attempted to keep the campaign and the functions of the White House as separate as possible. Though Nixon makes it clear that unidentified subordinates “whose zeal exceeded their judgment and who may have done wrong in a cause they deeply believed to be right” are the criminals in Watergate, since he is “the man at the top,” he “must bear the responsibility.” “That responsibility, therefore, belongs here, in this office. I accept it. And I pledge to you tonight, from this office, that I will do everything in my power to ensure that the guilty are brought to justice and that such abuses are purged from our political processes in the years to come, long after I have left this office.” The nation must allow the judicial system to do its work without interference, he says, and it must not distract the nation from “the vital work before us… at a time of critical importance to America and the world.” Nixon himself intends to return his “full attention” to the “larger duties of this office,” and allow the investigation to proceed without his direction. President Nixon formally asks for and receives the resignations of two of his most senior advisers, H. R. Haldeman and John Ehrlichman (see April 16-17, 1973 and April 24, 1973), along with Attorney General Richard Kleindienst. In addition, he fires White House counsel John Dean, who has begun cooperating with Watergate investigators (see April 6-20, 1973).
Replacements - Kleindienst is replaced by Defense Secretary Elliot Richardson, whom Nixon tasks with the responsibility for “uncovering the whole truth” about the Watergate scandal. Richardson will be given “absolute authority” in handling the Watergate investigation, including the authority to appoint a special prosecutor to supervise the government’s case (see April 30, 1973). Dean is replaced temporarily by Nixon’s personal lawyer Leonard Garment.
Additional Resignation - Also, Gordon Strachan, the general counsel to the United States Information Agency (USIA), resigns. Strachan is a former aide to Haldeman, and, according to a USIA statement, resigned “after learning that persons with whom he had worked closely at the White House had submitted their resignations.”
Lawmakers' Comments - Senate Majority Leader Hugh Scott (R-PA) says of the resignations: “[A] lack of grace in power has led to a fall from grace. This rotten vine of Watergate has produced poisonous fruit, and all nourished by it should be cast out of the Garden of Eden.” House Minority Leader Gerald Ford (R-MI) says the resignations are “a necessary first step by the White House in clearing the air on the Watergate affair.… I have the greatest confidence in the president and I am absolutely positive he had nothing to with this mess.” Representative John Moss (D-CA) says the House must prepare itself to deal with the possibility of impeachment, but “before we even suggest impeachment, we must have the most uncontroverted evidence.” In their letters of resignation, Haldeman and Ehrlichman promise to cooperate with the Justice Department investigation of Watergate. (Stern and Johnson 5/1/1973)
Reaction at the Washington Post - Knight Newspapers reporter James McCartney later writes an article for the Columbia Journalism Review on the Post’s Watergate coverage, which describes the reaction in the Post offices to the news: “For a split second [executive editor] Ben Bradlee’s mouth dropped open with an expression of sheer delight.… ‘How do you like them apples?’ he said to the grinning Simons [managing editor Howard Simons]. ‘Not a bad start.’” As reporters and employees begin gathering around, Simons murmurs: “Don’t gloat. We can’t afford to gloat.” (Bernstein and Woodward 1974, pp. 310)
Washington Post reporter Bob Woodward writes a memo to his editor, Ben Bradlee, largely based on his meetings with his FBI background source, “Deep Throat” (FBI deputy director W. Mark Felt—see May 31, 2005). The memo is full of material that will soon come out in either Senate testimony or the media, but also contains some information that Woodward cannot sufficiently confirm to allow him to write a news report. One of the most explosive items Woodward writes is the line, “Dean talked with Senator Baker after Watergate committee formed and Baker is in the bag completely, reporting back directly to White House.” If this is true, then according to former White House counsel John Dean, now cooperating with the Senate investigation, then the ranking Republican senator on the committee, Howard Baker (R-TN), is a White House “mole,” providing information directly to the White House about the committee’s deliberations, discussions, and future plans. The memo also reports that President Nixon personally threatened Dean and that another White House aide, Jack Caulfield, threatened Watergate burglar James McCord by saying “your life is no good in this country if you don’t cooperate” with the White House efforts to keep the Watergate conspiracy secret. The list of “covert national and international things” done by the Nixon re-election campaign were begun by campaign chief John Mitchell: “The list is longer than anyone could imagine.” According to Felt, “[t]he covert activities involve the whole US intelligence community and are incredible.” Felt refuses to give Woodward “specifics because it is against the law. The cover-up had little to do with the Watergate, but was mainly to protect the covert operations.” Felt has also told Woodward that Nixon himself is being blackmailed by one of the Watergate burglars, E. Howard Hunt (see June 20-21, 1972), at a total cost of around $1 million; the blackmail scheme involves just about every Watergate-connected figure in the White House. One reason the White House “cut loose” Mitchell was because Mitchell could not raise his portion of the money. Felt also told Woodward that senior CIA officials, including CIA director Richard Helms and deputy director Vernon Walters, are involved to some extent. Dean has explosive information that he is ready to reveal, but “plumber” G. Gordon Liddy is willing to go to jail or even die before revealing anything. Finally, rumors are running through the White House and the law enforcement and intelligence communities that Nixon is having “fits of ‘dangerous’ depression.” Some of this information will later be confirmed and reported, some of it will remain unconfirmed. (Bernstein and Woodward 1974, pp. 317-321; Spartacus Schoolnet 8/2007) Felt also warns Woodward that he, fellow Post reporter Carl Bernstein, and others at the newspaper may be under CIA surveillance and may even be in personal danger. The reporters confirm much of what Felt provided in a discussion with a Dean associate the next day. But both reporters and the Post editors worry that the new information might be part of an elaborate White House scheme to set up the reporters with false, discreditable information. In the following months, information elicted in the Senate committee hearings verifies everything Felt told Woodward, except the warning about being possibly wiretapped by the CIA. That is never verified. (Bernstein and Woodward 1974, pp. 317-321)
In regards to the Watergate investigations, President Nixon promises that he will not use the claim of executive privilege to impede testimony or the presentation of evidence: “Executive privilege will not be invoked as to any testimony concerning possible criminal conduct or discussions of possible criminal conduct, in the matters presently under investigation, including the Watergate affair, and the alleged cover-up.” It is with this understanding that former White House counsel John Dean testifies before the Senate Watergate Committee (see June 3, 1973). Former White House counsel John Dean has told Watergate investigators that he discussed the Watergate cover-up with President Nixon at least 35 times (Gerald R. Ford Library and Museum 7/3/2007) between January and April of 1973, according to sources quoted by the Washington Post. Dean plans on testifying to his assertions in the Senate Watergate hearings (see May 17-18, 1973), whether or not he is granted immunity from prosecution. He will also allege that Nixon himself is deeply involved with the Watergate cover-up. Nixon had prior knowledge of payments used to buy the silence of various Watergate conspirators, and knew of offers of executive clemency for the conspirators issued in his name. Dean has little solid evidence besides his own personal knowledge of events inside the White House.
Haldeman, Ehrlichman, Nixon Central Figures in Cover-Up - Dean will testify that two of Nixon’s closest aides, H. R. Haldeman and John Ehrlichman (see April 30, 1973), were also present at many of the meetings where the cover-up was discussed in Nixon’s presence. The White House, and Haldeman and Ehrlichman, have tried to portray Dean as the central figure in the Watergate conspiracy, and the Justice Department says there is ample evidence to indict Dean for a number of crimes related to the cover-up. Dean and his supporters paint Dean as a White House loyalist who merely did what he was told, until he began agonizing over the effect Watergate was having on Nixon. Dean alleges that Nixon asked him how much the seven Watergate defendants (see June 17, 1972) would have to be paid to ensure their silence, aside from the $460,000 already paid out; when Dean replied that the cost would be around $1 million, Nixon allegedly replied that such a payoff would be no problem. Dean has told investigators that later Nixon insisted he had been merely “joking” about the payoff. Dean says by that time—March 26—Nixon knew that Dean would be cooperating with the Watergate investigation, and that he believes Nixon was trying to retract the statement for his own legal well-being.
Pressured to Confess - Dean has also testified that Nixon tried to force him to sign a letter of resignation that would have amounted to a confession that Dean had directed the Watergate cover-up without the knowledge of Nixon, Haldeman, or Ehrlichman. When Dean refused to sign, he says, Nixon warned him “in the strongest terms” never to reveal the Nixon administration’s covert activities and plans. Dean also says that Nixon personally directed the White House’s efforts to counterattack the press over Watergate (see October 16-November, 1972). Until January 1, Dean has told investigators, he usually reported to Haldeman and Ehrlichman regarding his Watergate-related activities, but after that date Nixon began taking more of an active role in dealing with Dean, and gave Dean direct orders on handling the cover-up.
Reliable Witness - Dean has so far met eight times with the Watergate prosecutors, and twice with the chief legal counsel of the Senate Watergate committee, Samuel Dash. Dash and the prosecutors find Dean a compelling and believable witness. “[E]verything we have gotten from Dean that we were able to check out has turned out to be accurate,” says one Justice Department source. Dean says he tried without success to obtain records that would support his allegations in his final days in the White House, and believes that many of those records may have been destroyed by now. Dean did manage to remove some secret documents before his firing, documents that prompted Nixon to recently admit to “covert activities” surrounding Watergate. Dean’s information has already led to the revelation of the burglary of the office of Pentagon Papers leaker Daniel Ellsberg (see September 9, 1971), and to the resignation of FBI director L. Patrick Gray after Gray was found to have destroyed evidence taken from the safe of Watergate burglar E. Howard Hunt (see June 28, 1972). (Bernstein and Woodward 6/3/1973)
Washington Post reporter Carl Bernstein learns of White House aide Charles Colson’s plan to burglarize the Brookings Institution (see June 30-July 1, 1971 and June 1974), and, alarmingly, of Colson’s plans to actually firebomb the building. An associate of former White House counsel John Dean tells Bernstein that Colson did not want to just burglarize the Institute: “Chuck Colson wanted to rub two sticks together.”
Urgent Trip to See Nixon - Colson could not have been serious, Bernstein says, but the associate replies: “Serious enough for [White House aide] John Caulfield to run out of Colson’s office in a panic. He came straight to John Dean, saying he didn’t ever want to talk to that man Colson again because he was crazy. And that John better do something before it was too late. John caught the first courier flight out to San Clemente [President Nixon’s home in California] to see [then-White House aide John] Ehrlichman. That’s how serious it was.” Ehrlichman indeed shut the operation down before it could start, but the associate implies Ehrlichman’s decision may have been based more on the fact that Dean knew about it than over any shock or outrage over the firebombing plan.
Reasoning behind Attack - Colson wanted to firebomb Brookings because former Kissinger aide Morton Halperin, a Brookings fellow, may have had classified State Department documents at the Institute that the White House wanted back. A fire at the Institute would cover up a burglary of Halperin’s office.
Confirmation from Associate - Bernstein confirms the story from an associate of Caulfield’s, who clarifies: “Not a fire, a firebombing. That was what Colson thought would do the trick. Caulfield said, ‘This has gone too far’ and [that] he didn’t ever want anything to do with Colson again in his life.” Both Dean and Caulfield told FBI investigators about the plan, Caulfield’s associate says.
Woodward Calls Colson - When Bernstein’s colleague Bob Woodward calls Colson for a comment on the story, Colson jokes: “There’s no question about that. There is one mistake. It was not the Brookings, but the Washington Post. I told them to hire a wrecking crane and go over and knock down the building and Newsweek also.… I wanted the Washington Post destroyed.” When Woodward tells him the newspaper is printing the story, Colson retorts: “Explicitly, it is bullsh_t. I absolutely made no such statement or suggestion. It is ludicrous.… [T]his one has gone too far.” Colson calls back and says he may have made such a suggestion, but he was not serious. The Post prints the story. (Bernstein and Woodward 1974, pp. 324-325)
Confirmation by Dean - In 2006, Dean will write that when he “learned of [Colson’s] insane plan, I flew to California… to plead my case to John Ehrlichman, a titular superior to both Colson and myself. By pointing out, with some outrage, that if anyone died it would involve a capital crime that might be traced back to the White House, I was able to shut down Colson’s scheme.” (Dean 2006, pp. xxiii)
Three government sources say that former White House aide John Ehrlichman and former White House counsel John Dean secretly recorded telephone and face-to-face conversations with other Watergate conspirators, beginning in January 1973. Ehrlichman taped a conversation with former FBI director L. Patrick Gray concerning incriminating files removed from the safe of Watergate burglar E. Howard Hunt (see June 28, 1972), and another conversation with Dean about the same documents. In January, Dean taped several conversations with political operative Donald Segretti (see June 27, 1971, and Beyond). (Woodward and Bernstein 6/13/1973)
In five days of explosive testimony before the Senate Watergate Committee, former White House counsel John Dean claims that President Nixon was personally involved with the cover-up of the Watergate burglary (see 2:30 a.m.June 17, 1972 and June 3, 1973) within days of the crime. Dean gives a seven-hour opening statement detailing a program of political and campaign espionage activities conducted by the White House in recent years. He also tells the committee that he believes Nixon has tape-recorded some of the conversations regarding the Watergate conspiracy (see July 13-16, 1973). Dean tells the committee that he has White House documents detailing elements of the conspiracy in a safe-deposit box, and has given the keys to that box to Judge John Sirica, the judge overseeing the Watergate prosecutions. (Gerald R. Ford Library and Museum 7/3/2007; Spartacus Schoolnet 8/2007) Dean, described by Time Magazine as “owlish” and speaking “in a lifeless monotone,” nevertheless displays “impressive poise and a masterly memory” as he “sp[ins] his detailed web of evidence. He readily admit[s] his own illegal and improper acts. But he emerge[s] unshaken from five full days of recital and cross examination, with his basic story challenged but intact.” Without a convincing rebuttal, it would be difficult for either the committee or the nation to believe that Nixon “was not an active and fully aware participant in the Watergate cover-up, as Dean charged.”
Implicates Nixon Aides - While Dean admits that he had no first-hand knowledge of Nixon’s complicity until September 1972, he directly implicates Nixon’s two most senior aides at the time, H. R. Haldeman and John Ehrlichman, of what Time calls “multiple actions in the Watergate coverup,” as well as former Nixon campaign chairman John Mitchell.
White House-Sourced Questioning of Dean Backfires - An initial White House attempt at rebutting Dean’s testimony, consisting of a statement and a list of questions drawn up by White House counsel Fred Buzhardt, are “easily handled” by Dean, and even backfires, to the point where the White House disavows any involvement in the material, saying that they were “Buzhardt’s friendly personal contribution to the proceedings.” The questions attempt to portray Dean as the “mastermind” behind the Watergate conspiracy, with Mitchell his “patron.” Time writes, “Creating a constitutional crisis almost alone, the Buzhardt statement in effect charge[s], Dean and Mitchell kept the truth of all that concealed for some nine months from such shrewd White House officials as H. R. Haldeman, John Ehrlichman, Charles W. Colson—and the president.” But few on the committee find Buzhardt’s contention believable, considering the increasing amount of evidence to the contrary.
Testimony Details 'Climate of Fear' at White House - As yet much of Dean’s testimony remains uncorroborated, but, Time writes: “even if those facts leave many unconvinced of Nixon’s complicity in Watergate, Dean’s dismaying description of the climate of fear existing within the Nixon White House is almost as alarming as the affair that it spawned. With little regard for the law and under repeated proddings by the president himself. Dean contended, the Nixon staff used or contemplated using almost any available tactic to undermine political opponents, punish press critics, subdue antiwar protesters and gather political intelligence, including lists of ‘enemies’” (see June 27, 1973). Overall, Dean says, the Watergate break-in (see 2:30 a.m.June 17, 1972) was “the first act in a great American tragedy” and he finds it “very difficult” to testify about what others, including “men I greatly admire and respect,” had done. He finds it easier to admit to his own crimes. (Time 7/9/1973)
Former White House counsel John Dean, continuing his testimony before the Senate Watergate Committee (see June 25-29, 1973), provides a sheaf of documents to the committee. Among those is the “Opponents List and Political Enemies Project,” informally called President Nixon’s “enemies list.” The list is actually a set of documents “several inches thick” of names and information about Nixon’s political enemies. It was compiled by a number of administration officials, including Dean, White House aides Charles Colson, Gordon Strachan, and Lyn Nofziger, beginning in 1971. One of the documents from August 16, 1971, has Dean suggesting ways in which “we can use the available federal machinery to screw our political enemies.” Methods proposed included administration manipulation of “grant availability, federal contracts, litigation, prosecution, etc.” The Dean memo was given to then-chief of staff H. R. Haldeman and top White House aide John Ehrlichman for approval. Though Dean testifies that he does not know if the plan was set into motion, subsequent documents submitted to the committee indicate that it was indeed implemented. A condensed list of 20 “White House enemies” was produced by Colson’s office; a larger list included ten Democratic senators, all 12 black House members, over 50 news and television reporters, prominent businessmen, labor leaders, and entertainers, and contributors to the 1972 presidential campaign of Democratic senator Edmund Muskie. The condensed list includes, in priority order:
“1. Arnold M. Picker, United Artists Corp., NY. Top Muskie fund raiser. Success here could be both debilitating and very embarrassing to the Muskie machine. If effort looks promising, both Ruth and David Picker should be programmed and then a follow through with United Artists.”
“2. Alexander E. Barkan, national director of AFL-CIO’s committee on Political Education, Washington D.C.: Without a doubt the most powerful political force programmed against us in 1968 ($10 million, 4.6 million votes, 115 million pamphlets, 176,000 workers—all programmed by Barkan’s COPE—so says Teddy White in The Making of the President 1968). We can expect the same effort this time.”
“3. Ed Guthman, managing editor, Los Angeles Times: Guthman, former Kennedy aide, was a highly sophisticated hatchetman against us in ‘68. It is obvious he is the prime mover behind the current Key Biscayne effort. It is time to give him the message.”
“4. Maxwell Dane, Doyle, Dane and Bernbach, NY: The top Democratic advertising firm—they destroyed Goldwater in ‘64. They should be hit hard starting with Dane.”
“5. Charles Dyson, Dyson-Kissner Corp., NY: Dyson and [Democratic National Committee chairman] Larry O’Brien were close business associates after ‘68. Dyson has huge business holdings and is presently deeply involved in the Businessmen’s Educational Fund which bankrolls a national radio network of five-minute programs—anti-Nixon in character.”
“6. Howard Stein, Dreyfus Corp., NY: Heaviest contributor to [Democratic presidential candidate Eugene] McCarthy in ‘68. If McCarthy goes, will do the same in ‘72. If not, Lindsay or McGovern will receive the funds.”
“7. [US Representative] Allard Lowenstein, Long Island, NY: Guiding force behind the 18-year-old ‘Dump Nixon’ vote campaign.”
“8. Morton Halperin, leading executive at Common Cause: A scandal would be most helpful here.”
“9. Leonard Woodcock, UAW, Detroit, Mich.: No comments necessary.”
“10. S. Sterling Munro Jr., Sen. [Henry Jackson’s aide, Silver Spring, Md: We should give him a try. Positive results would stick a pin in Jackson’s white hat.”
“11. Bernard T. Feld, president, Council for a Livable World: Heavy far left funding. They will program an ‘all court press’ against us in ‘72.”
“12. Sidney Davidoff, New York City, [New York City Mayor John V.] Lindsay’s top personal aide: a first class SOB, wheeler-dealer and suspected bagman. Positive results would really shake the Lindsay camp and Lindsay’s plans to capture youth vote. Davidoff in charge.”
“13. John Conyers, congressman, Detroit: Coming on fast. Emerging as a leading black anti-Nixon spokesman. Has known weakness for white females.”
“14. Samuel M. Lambert, president, National Education Association: Has taken us on vis-a-vis federal aid to parochial schools—a ‘72 issue.” (Facts on File 6/2003) Committee chairman Sam Ervin (D-NC) is clearly outraged by the list, and particularly by Lambert’s inclusion. He says, “Here is a man listed among the opponents whose only offense is that he believed in the First Amendment and shared Thomas Jefferson’s conviction, as expressed in the Virginia Statute for Religious Freedom, that to compel a man to make contributions of money for the dissemination of religious opinions he disbelieves is sinful and tyrannical. Isn’t that true?” Dean replies, “I cannot disagree with the chairman at all.” (Time 7/9/1973)

Another “master list” of political enemies prepared by Colson’s office includes Democratic senators Birch Bayh, J. W. Fulbright, Fred R. Harris, Harold Hughes, Edward M. Kennedy, George McGovern, Walter Mondale, Edmund Muskie, Gaylord Nelson, and William Proxmire; House representatives Bella Abzug, William R. Anderson, John Brademas, Father Robert F. Drinan, Robert Kastenmeier, Wright Patman; African-American representatives Shirley Chisholm, William Clay, George Collins, John Conyers, Ronald Dellums, Charles Diggs, Augustus Hawkins, Ralph Metcalfe, Robert N.C. Nix, Parren Mitchell, Charles Rangel, Louis Stokes; and several other politicians, including Lindsay, McCarthy, and George Wallace, the governor of Alabama (see May 15, 1972). The list also includes an array of liberal, civil rights and antiwar organizations, including the Black Panthers, the Brookings Institution, Common Cause, the Farmers Union, the National Economic Council, the National Education Association, the National Welfare Rights Organization, the Southern Christian Leadership Convention; a variety of labor organizations; many reporters, columnists, and other news figures; a short list of celebrities including Bill Cosby, Jane Fonda, Dick Gregory, Steve McQueen, Joe Namath, Gregory Peck, Tony Randall, and Barbra Streisand; and a huge list of businessmen and academics. The documents provide suggestions for avenues of attack against individual listees, including using “income tax discrepancies,” allegations of Communist connections, and other information. (Facts on File 6/2003) In 1999, Schorr will joke that being on Nixon’s enemies list “changed my life a great deal. It increased my lecture fee, got me invited to lots of very nice dinners. It was so wonderful that one of my colleagues that I will not mention, but a very important man at CBS, said, ‘Why you, Schorr? Why couldn’t it have been me on the enemies list?’” (CNN 3/27/1999) Schorr does not mention that he was the subject of an FBI investigation because of his listing. (Spartacus Schoolnet 8/2007)
White House aide Alexander Butterfield shocks the Senate Watergate Committee with his revelation of a secret recording system in the White House. Butterfield reveals that since 1971, President Nixon has been recording every conversation and telephone call in the Oval Office. (Gerald R. Ford Library and Museum 7/3/2007) Butterfield is actually the aide who, at Nixon’s request, had the taping system installed. (Sussman 1974) He is now the administrator of the Federal Aviation Administration.
Taping System Installed in 1970 at Nixon's Behest - Butterfield says the taping system was installed in the spring or summer of 1970, but corrects his testimony after committee chairman Sam Ervin reads him a letter from Nixon lawyer Fred Buzhardt stating that the first time the system was used was the spring of 1971; Butterfield then says the system was installed at that time (see February 1971). The system was installed and operated by Secret Service agents. Asked why Nixon would have such a system, Butterfield replies, perhaps ingenuously, “There was no doubt in my mind they were installed to record things for posterity, for the Nixon library.” Committee counsel Samuel Dash says the committee will request selected tapes to hear for themselves. Watergate prosecutor Archibald Cox is also expected to request some of the tapes. Dash acknowledges that two other Nixon aides, H. R. Haldeman and Lawrence Higby, were also asked about the existence of the taping system, but both have refused to confirm the existence of the device. (Meyer 7/17/1973) Secretary of State Henry Kissinger’s deputy, Alexander Haig, also knew of the taping system, but Kissinger himself did not know. Former White House counsel John Dean suspected that such a system existed. (Bernstein and Woodward 1974, pp. 331)
'Small Fry' - Butterfield is described by one reporter as a “small fry,” the man responsible for keeping Nixon’s schedule and handling paper flow. On July 13, three committee staff members prepare Butterfield for his public testimony of July 16. They ask whether there is a White House recording system, but are not prepared for Butterfield’s answer, or the ramifications of his admission. Butterfield makes the same admission three days later, in open testimony before the committee and the television cameras, and in more detail. (Feinsilber 6/7/1997) Butterfield explains his reluctance to discuss the recording system by saying, “It is very obvious that this could be—I cannot say that any longer—is embarrassing to our government.” (Meyer 7/17/1973)
No Longer Dean's Word Against Nixon's - During preparation, when the staff members ask Butterfield how the White House could have such detailed knowledge of the conversations, Butterfield replies: “I was hoping you guys wouldn’t ask me that.… Well, yes, there’s a recording system in the White House.” Nixon had had five voice-activated microphones placed in his desk in the Oval Office and two in wall lamps by the office fireplace, Butterfield reveals. More were in the Cabinet Room, Nixon’s “hideaway” office in the Old Executive Office Building, and even at Camp David, the presidential retreat. Before Butterfield’s testimony, Nixon and his top legal advisers felt they could duck and deny the worst charges against them. They feel that much of the Watergate imbroglio boils down to Nixon’s word against White House whistleblower John Dean (who had informed the committee that he suspected a recording system existed), and as Haig, who succeeded Haldeman as Nixon’s chief of staff, told Nixon: “Nobody in Congress likes [Dean]. We can take the son of a b_tch on.” Few in the White House know of Nixon’s secret and extensive taping system. Although senior Nixon aide H. R. Haldeman had told the few aides who do know of the system to invoke executive privilege and refuse to discuss it, Haig quietly told at least one aide, his former deputy Lawrence Higby, to “tell the truth” if asked under oath. Nixon’s lawyers had effectively rebutted Dean’s earlier testimony when Buzhardt secretly supplied a sympathetic Senate lawyer with highly detailed, nearly verbatim accounts of Nixon and Dean’s private conversations—accounts drawn from the secret tapes. Haig will later claim to be “shocked” at Butterfield’s revelation, saying, “It never occurred to me that anyone in his right mind would install anything so Orwellian as a system that never shut off, that preserved every word, every joke, every curse, every tantrum, every flight of presidential paranoia, every bit of flattery and bad advice and tattling by his advisers.” In reality, Haig had known of the system for months before Butterfield’s testimony, and had advised Nixon to have the tapes destroyed before the Watergate prosecutors could get their hands on them. (Meyer 7/17/1973; Werth 2006, pp. 81-82) “Without the tapes,” reporter Mike Feinsilber will write in 1997, “it was unlikely Nixon would have had to give up the presidency.” (Feinsilber 6/7/1997) Butterfield was considered so unimportant that, had Washington Post reporters Bob Woodward and Carl Bernstein not pressured committee lawyers to interview him, the committee may not have bothered with him. (Bernstein and Woodward 1974, pp. 330-331)
White House special counsel Richard Moore, who testifies to the Senate Watergate Committee before former White House aide Alexander Butterfield admits to the existence of a secret White House taping system (see July 13-16, 1973), insists that it is his “firm conviction” that President Nixon knew nothing of the cover-up of the Watergate conspiracy until March 21, 1973 (see March 21, 1973). Moore recalls an April 19 conversation with Nixon, in which Nixon allegedly said that then-White House counsel John Dean had told Nixon of the cover-up on March 21. According to Moore, Dean also told Nixon about the demands for “hush money” from convicted Watergate burglar E. Howard Hunt to keep Hunt quiet about his knowledge of the burglary of the office of Daniel Ellsberg’s psychiatrist (see September 9, 1971). Terry Lenzner, one of the committee’s lawyers, reads White House log summaries made by Republican committee counsel Fred Thompson, summaries that have been verified as accurate by White House officials. Moore refuses to acknowledge that those log summaries are accurate reflections of conversations held by Nixon. Moore says that he had concluded on March 20 that Nixon “could not be aware of the things that Mr. Dean was worried about,” including the cover-up and the potential of it being publicly revealed. Lenzner asks: “Mr. Moore, do you agree now that your understanding of the president’s information and knowledge was basically incorrect. That he did, in fact, have information at that meeting… on March 20 concerning [Gordon] Strachan [an aide to Chief of Staff H. R. Haldeman] and also possible involvement in Watergate and also involving the Ellsberg break-in?” Moore replies: “You have heard my statement on that, of course, that [Nixon] did not, that it was my judgment that he did not. I know of nothing to change that.” Dean has testified that on March 13 he told Nixon of Strachan’s possible involvement with the cover-up, and on March 17 he told Nixon of the Ellsberg break-in, testimony substantiated by the White House log summaries. Moore suggests that the committee ask someone who was at those meetings. Moore’s testimony will be proven false by the so-called “Nixon tapes.” (Meyer 7/17/1973)
President Nixon delivers his second prime-time televised speech about Watergate to the nation. He says that both the Senate investigations have focused more on trying to “implicate the president personally in the illegal activities that took place,” and reminds listeners that he has already taken “full responsibility” for the “abuses [that] occurred during my administration” (see April 30, 1973). But in light of the increasing evidence being revealed about the Watergate conspiracy, Nixon’s speech is later proven to be a compilation of lies, half-truths, justifications, and evasions.
'No Prior Knowledge' - He again insists that “I had no prior knowledge of the Watergate break-in; I neither took part in nor knew about any of the subsequent cover-up activities; I neither authorized nor encouraged subordinates to engage in illegal or improper campaign tactics. That was and that is the simple truth.” He says that in all the Senate testimony, “there is not the slightest suggestion that I had any knowledge of the planning for the Watergate break-in.” He says only one witness has challenged his statement under oath, referring to former White House counsel John Dean (see April 6-20, 1973) and June 25-29, 1973), and says Dean’s “testimony has been contradicted by every other witness in a position to know the facts.” Instead, says Nixon, he insisted from the outset that the investigation into the Watergate burglary be “thorough and aboveboard,” and if there were any evidence of “higher involvement, we should get the facts out first.” A cover-up would be unconscionable, he says. He again insists that he was told in September 1972 that an FBI investigation, “the most extensive investigation since the assassination of President Kennedy… had established that only those seven (see June 17, 1972) were involved.” Throughout, Nixon says, he relied on the reports of his staff members, Justice Department, and FBI officials, who consistently reassured him that there was no involvement by anyone in the White House in the burglaries. “Because I trusted the agencies conducting the investigations, because I believed the reports I was getting, I did not believe the newspaper accounts that suggested a cover-up. I was convinced there was no cover-up, because I was convinced that no one had anything to cover up.”
Internal Investigation - He didn’t realize that those assurances were wrong until March 21, when he “received new information from [Dean] that led me to conclude that the reports I had been getting for over nine months were not true.” He immediately launched an internal investigation (see August 29, 1972), initially relying on Dean to conduct the investigation, then turning the task over to his senior aide, John Ehrlichman, and to the Attorney General, Richard Kleindienst. The results prompted him to give the case to the Criminal Division of the Justice Department, ordering the complete cooperation of “all members of the administration.” He never tried to hide the facts, Nixon asserts, but instead has consistently tried “to discover the facts—and to lay those facts before the appropriate law enforcement authorities so that justice could be done and the guilty dealt with.”
Refusal to Turn over Tapes; 'Privileged' Communications - Nixon says he is resisting subpoenas to turn over the secret recordings he has had made of White House and other conversations (see July 13-16, 1973) because of “a much more important principle… than what the tapes might prove about Watergate.” A president must be able to talk “openly and candidly with his advisers about issues and individuals” without having those conversations ever made public. These are “privileged” conversations, he says, similar to those between a lawyer and his client or “a priest and a penitent.” The conversations between a president and his advisers, Nixon says, are “even more important.” The conversations on those tapes are “blunt and candid,” made without thought to any future public disclosure, and for future presidents and their advisers to know that their conversations and advice might one day be made public would cripple their ability to talk freely and offer unfettered opinions. “That is why I shall continue to oppose efforts which would set a precedent that would cripple all future presidents by inhibiting conversations between them and those they look to for advice,” he says. “This principle of confidentiality of presidential conversations is at stake in the question of these tapes. I must and I shall oppose any efforts to destroy this principle.”
'Hard and Tough' Politics - Watergate has come to encompass more than just a burglary, Nixon says, but has brought up issues of partisan politics, “enemy lists” (see June 27, 1973), and even threats to national security. Nixon has always run “hard and tough” political campaigns, but has never stepped outside the law and “the limits of decency” in doing so. “To the extent that these things were done in the 1972 campaign, they were serious abuses, and I deplore them,” he says. The “few overzealous people” involved in the Watergate burglary should not reflect on his administration or the political process as a whole. He will “ensure that one of the results of Watergate is a new level of political decency and integrity in America—in which what has been wrong in our politics no longer corrupts or demeans what is right in our politics.”
Legal Wiretapping to Protect the Nation - The measures he has taken to protect the security of the nation have all been within the law and with the intention of protecting the government from possible subversion and even overthrow, he asserts. The wiretaps he authorized had been legal, he says, until the 1972 decision by the Supreme Court that rejected such wiretaps as unlawful (see June 19, 1972). Until then, Nixon says, he—like his predecessors—had implemented such wiretaps “to protect the national security in the public interest.” Since the Supreme Court decision, he says, he has stopped all such surveillance efforts. But the law must be mindful of “tying the president’s hands in a way that would risk sacrificing our security, and with it all our liberties.” He will continue to “protect the security of this nation… by constitutional means, in ways that will not threaten [American] freedom.”
The Fault of the Radicals - He blames the antiwar and civil rights movements of the 1960s as encouraging “individuals and groups… to take the law into their own hands,” often with the praise and support from the media and even from “some of our pulpits as evidence of a new idealism. Those of us who insisted on the old restraints, who warned of the overriding importance of operating within the law and by the rules, were accused of being reactionaries.” In the wake of this radical, anti-government atmosphere, the country was plagued by “a rising spiral of violence and fear, of riots and arson and bombings, all in the name of peace and in the name of justice. Political discussion turned into savage debate. Free speech was brutally suppressed as hecklers shouted down or even physically assaulted those with whom they disagreed. Serious people raised serious questions about whether we could survive as a free democracy.” That attitude permeated political campaigns, to the extent that “some persons in 1972 adopted the morality that they themselves had tightly condemned and committed acts that have no place in our political system… who mistakenly thought their cause justified their violations of the law.”
Looking Forward - It is time to put Watergate behind us, Nixon says, to abandon this “continued, backward-looking obsession with Watergate” and stop “neglect[ing] matters of far greater importance to all of the American people.… The time has come to turn Watergate over to the courts, where the questions of guilt or innocence belong. Convicted Watergate burglar E. Howard Hunt testifies before the Senate Watergate Committee. He has been adamant about remaining silent before the investigators, both when he was interrogated by the FBI and the Watergate grand jury prosecutors, and had inspired the four so-called “Cubans” among the burglars—Bernard Barker, Virgilio Gonzales, Eugenio Martinez, and Frank Sturgis—to also remain silent. The “Cubans” are aghast at Hunt’s open testimony in the Senate; among other things, he confirms that former Nixon White House and campaign aides John Mitchell, John Dean, and Jeb Magruder were primarily responsible for the covert actions of the Nixon campaign, and says that the CIA is heavily involved in domestic activities. Hunt’s fellow White House aide, G. Gordon Liddy, who has also remained obstinately silent, is overtly disgusted at Hunt. Former White House counsel John Dean pleads guilty to one count of conspiracy to obstruct justice in regards to his role in the Watergate cover-up. In return for his continued cooperation with the FBI and the Senate Watergate Committee (see April 6-20, 1973), Special Prosecutor Archibald Cox grants Dean immunity from any further Watergate-related charges. Former White House aides John Ehrlichman, Charles Colson, and G. Gordon Liddy, and three Cuban-Americans, including two of the convicted Watergate burglars (see January 8-11, 1973), Bernard Barker and Eugenio Martinez, are charged with planning and executing the burglary of the offices of Dr. Lewis Fielding, Pentagon Papers leaker Daniel Ellsberg’s psychiatrist (see September 9, 1971). Colson will quickly reach a plea-bargain agreement, promise to cooperate with the prosecution, plead guilty to one count of obstruction of justice, and serve approximately seven months in prison. (Bernstein and Woodward 1974, pp. 335; Billy Graham Center 12/8/2004) He will also be disbarred. In the guilty plea agreement, Colson admits to having devised “a scheme to obtain derogatory information about Daniel Ellsberg,” who himself was facing criminal charges relating to the Pentagon Papers leak. Colson wanted to smear Ellsberg’s reputation in the media, in essence having Ellsberg “tried in the newspapers” even though this would have an “adverse effect on his right to a fair trial.” Colson also admits to having written a “scurrilous and libelous memorandum” about one of Ellsberg’s attorneys. He does not admit to actually taking part in the planning of the Fielding burglary. (Time 6/17/1974) In 2006, White House counsel John Dean will write that Colson’s promise of cooperation is virtually worthless: “[I]n the end he proved to be utterly useless as a government witness, since the government could not vouch for his honesty.” (Dean 2006, pp. xxiii)
President Nixon still refuses to hand over the tapes subpoenaed by the Watergate special prosecutor, Leon Jaworski (see April 16, 1974). Instead, Nixon provides more edited transcripts of the tapes to the House Judiciary Committee. (Gerald R. Ford Library and Museum 7/3/2007)
Transcripts Prove His Innocence, Nixon Claims - A summary of the tapes, written by White House officials, says that the transcripts prove Nixon’s innocence. “In all of the thousands of words spoken,” the summary says, “even though they often are unclear and ambiguous, not once does it appear that the president of the United States was engaged in a criminal plot to obstruct justice.” (Johnson 5/1/1974) Shortly after the release of the transcripts, Nixon appears on television with a pile of looseleaf notebooks—the transcripts, which he says he has personally compiled—and says: “In these transcripts, portions not relevant to my knowledge or actions with regard to Watergate are not included, but everything that is relevant is included—the rough as well as the smooth—the strategy sessions, the exploration of alternatives, the weighing of human and political costs. As far as what the president personally knew and did with regard to Watergate and the cover-up is concerned, these materials—together with those already made available—will tell it all.… I want there to be no question remaining about the fact that the president has nothing to hide in this matter.” (Nixon 4/29/1974; Nixon 4/29/1974; Nixon 4/29/1974; Nixon 4/29/1974; Washington Post 2007) “As far as the president’s role with regard to Watergate is concerned,” Nixon claims, “the entire story is there.” (Reeves 2001, pp. 608) He rails against the idea of impeaching him (see February 6, 1974), saying that the charges are based on “[r]umor, gossip, innuendo, [and] accounts from unnamed sources,” and implicitly accuses former White House counsel John Dean of lying about his involvement in the Watergate cover-up (see April 6-20, 1973). The 18 ½ minute erasure on one of the key tape recordings (see November 21, 1973) is “a mystery” to him, Nixon asserts. The nation must move past Watergate to deal with more serious matters, he says. (Washington Post 2007)
Reaction Divided - Reaction on Congress is divided largely along party lines. House Minority Leader John Rhodes (R-AZ) says the transcripts show Nixon is “in substantial compliance” with a Judiciary Committee subpoena. Speaker of the House Carl Albert (D-FL) has a different view: “Why substitute other evidence when the direct evidence [the actual tapes] is available?” (Johnson 5/1/1974)
Transcripts Heavily Edited, Doctored - It quickly becomes evident that the transcripts have been heavily edited and altered, both to clean up Nixon’s language and to cloak the details of the events documented in the tapes. Only 11 of the 64 conversations cited in the subpoenas are present, and those have been doctored. The term “expletive deleted” quickly enters the political and popular lexicon, and even with much of the profanity and ethnic slurs deleted, the impression given by the transcripts is not popular with the American people; in the words of reporter Mike Feinsilber, the transcripts show Nixon “as a vengeful schemer—rambling, undisciplined, mean-spirited and bigoted.” Even the edited transcripts document Nixon participating in discussions about raising blackmail money and “laundering” payments, offering clemency or parole to convicted Watergate figures, discussing how to handle perjury or obstruction of justice charges, and debating how best to use the term “national security” to advance his own personal and political agendas. In one conversation, Dean says that one of their biggest problems is that they are not “pros” at the kinds of activities they are engaging in: “This is the sort of thing Mafia people can do.” Nixon replies: “That’s right.… Maybe it takes a gang to do that.” The Judiciary Committee immediately joins the special prosecutor in demanding the actual tapes. (Johnson 5/1/1974; Feinsilber 6/7/1999; Reeves 2001, pp. 608)
The Justice Department’s Office of Planning and Evaluation (OPE) submits a report on the role and actions of the FBI in the Watergate investigations. The report finds that, even with the attempts of former Attorneys General John Mitchell and Richard Kleindienst, White House aides John Dean and Jeb Magruder, and others to “mislead and thwart the Bureau’s legitimate line of inquiry,” and the “contrived covers” used to direct attention away from the White House, the FBI investigation was “the ultimate key to the solution of not only the Watergate break-in (see 2:30 a.m.June 17, 1972) but the cover itself.” The report continues: “There can be no question that the actions of former Attorneys General Mitchell and Kleindienst served to thwart and/or impede the Bureau’s investigative effort. The actions of John W. Dean at the White House and Jeb S. Magruder at the Committee to Re-elect the President were purposefully designed to mislead and thwart the Bureau’s legitimate line of inquiry. At every stage of the investigation there were contrived covers placed in order to mislead the investigators.” The OPE notes the following problems in the investigation, and provides explanations of some:
Providing information concerning ongoing investigations to the White House, and allowing Dean to actually sit in on interviews of White House personnel (see June 22, 1972).
Failing to interview key members of CREEP, the Nixon re-election campaign organization, as well as allowing CREEP attorneys to sit in on interviews of CREEP employees and allowing those attorneys access to FBI investigative materials. The report says that the investigation initially focused on James McCord and E. Howard Hunt, and interviewed CREEP officials tied directly to them. The net was widened later on. However, the report acknowledges that many CREEP employees undoubtedly lied to FBI investigators, “most notably John Mitchell, Jeb Magruder, Bart Porter, Sally Harmony, and Maurice Stans.” Porter and Magruder in particular “lied most convincingly.” Another CREEP employee, Robert Reisner (Magruder’s assistant), was not interviewed because Reisner successfully hid from FBI investigators. The FBI believes it was Reisner who cleaned out the “Operation Gemstone” files from Magruder’s office (see January 29, 1972 and September 29, 1972). Numerous other financial and other files were also destroyed after being requested by the FBI, most notably Alfred Baldwin’s surveillance tapes and logs from the Democratic offices in the Watergate (see May 29, 1972). Many of these files were destroyed by G. Gordon Liddy. “It is apparent that most [CREEP] people in the summer of 1972 were quite willing to lie and/or tell us considerably less than the full truth,” the report notes.
An untenable delay in searching and securing Watergate burglar E. Howard Hunt’s desk in the White House, putting the contents of that desk at risk of being removed, and the “[a]lleged activities by former Acting Director [L. Patrick] Gray to limit, contain, or obstruct FBI investigation of Watergate” (see June 22, 1972). Gray is known to have destroyed materials from Hunt’s desk given to him by Dean, and is known to have extensively interfered with the FBI’s investigation (see June 28-29, 1972 and Late December 1972). The report notes that while it cannot find specific evidence that Gray broke any laws in his attempts to impede the FBI’s investigation into the Watergate conspiracy, it is clear that Gray cooperated with the White House, specifically through Dean, to ensure that the White House was always aware of what avenues of investigation were being pursued. The OPE says that Gray’s destruction of files from Hunt’s safe did not necessarily impede the FBI’s investigation, because it has no way of knowing what was in those files. The report says that it is unfortunate that “many people make no distinction between the FBI’s actions and Mr. Gray’s actions.”
Failure to interview key individuals with knowledge of the suspicious monies found in the burglars’ bank accounts.
Failing to secure and execute search warrants for the burglars’ homes, automobiles, and offices. The OPE says that many of those issuing this criticism “should know better,” and claims that the FBI agents involved did their level best to obtain search warrants within the bounds of the law. The report notes that after the burglary, the assistant district attorney prosecuting the case, Earl Silbert, did not believe there was probable cause to search burglar James McCord’s home or office until after July 10, 1972, when Baldwin told the FBI that he had taken surveillance equipment to McCord’s home (see June 17, 1972). Even then, Silbert decided that because of the amount of time—23 days—that had expired, a search warrant would have been pointless.
Failing to identify and interview a number of people listed in the burglars’ address books. The OPE report notes that the decision to interview far less than half of the names in the books was made by FBI agents in the Miami field office, and due to the “fast moving extensive investigation which was then being conducted,” the decision to only track down a selected few from the books was right and proper. The report notes that subsequent interviews by reporters of some of the people in the address books elicited no new information. The report also notes that Gray refused to countenance interviews of the remaining subjects in the address book while the trial of the seven burglars (see January 8-11, 1973) was underway.
Failing to find and remove a surveillance device from the Democratic National Committee headquarters (see September 13, 1972). The OPE calls this failure “inexplicable.”
Failure to thoroughly investigate CREEP agent Donald Segretti (see June 27, 1971, and Beyond) and other CREEP operatives. The OPE finds that because Segretti was initially uncooperative with FBI investigators, and because an “extensive investigation” turned up nothing to connect Segretti with the Watergate conspiracy, the agents chose not to continue looking into Segretti’s actions. Only after press reports named Segretti as part of a massive, White House-directed attempt to subvert the elections process (see October 7, 1972) did the FBI discuss reopening its investigation into Segretti. After reviewing its information, the FBI decided again not to bother with Segretti. The OPE finds that the decision was valid, because Segretti had not apparently broken any federal laws, and the FBI does not conduct violations of election laws unless specifically requested to do so by the Justice Department. The report also says that politics were a concern: by opening a large, extensive investigation into the Nixon campaign’s “dirty tricks,” that investigation might have impacted the upcoming presidential elections.
Media leaks from within the FBI concerning key details about the investigation (see May 31, 2005). The report finds no evidence to pin the blame for the leaks on any particular individual. The report notes that New York Times reporter John Crewdson seemed to have unwarranted access to FBI documents and files, but says it has turned that matter over to another agency inside the bureau.
Failing to interview, or adequately interview, key White House officials such as H. R. Haldeman, Charles Colson, Dwight Chapin, and others. The report justifies the decision not to interview Haldeman because the FBI had no information that Haldeman had any knowledge of, or involvement in, the burglary itself.
“Alleged attempt on part of Department of Justice officials to limit, contain, or obstruct FBI investigation.” The report is particularly critical of Kleindienst’s concealment of his contact with Liddy about the burglary (see June 17, 1972).
“Alleged attempt by CIA officials to interfere, contain, or impede FBI Watergate investigation.” The report notes that during the Senate Watergate Committee hearings, Republican co-chairman Howard Baker (R-TN) tried repeatedly to assert that the CIA was behind the burglary. The report calls Baker’s theory “intriguing” but says no evidence of CIA involvement on any operational level was ever found. The report notes that there is still no explanation for the discussions regarding the CIA paying the burglars (see June 26-29, 1972), or the CIA’s involvement with Hunt before the burglary—loaning him cameras, providing him with materials for a disguise, and helping Hunt get film from the first burglary developed. According to the report, Gray stopped the FBI from pursuing these leads. The FBI report says that the CIA involvement apparently had nothing to do with the Watergate burglary, but was more in support of Hunt’s activities with the Ellsberg break-in (see September 9, 1971).
“Alleged activities on part of White House officials to limit, contain, or obstruct FBI Watergate investigation (Dean, Haldeman, Ehrlichman, Colson, et cetera).” The report notes, “There is absolutely no question but that the president’s most senior associates at the White House conspired with great success for nine months to obstruct our investigation.” The report says it was “common knowledge” throughout the investigation that the White House was paying only “lip service” to investigators’ requests for honest, complete answers; the report cites Dean as a specific offender. Former White House counsel John Dean begins a one-to-four-year term in prison for his role in the Watergate coverup. Dean’s sentence would have been far longer had he not cooperated so completely with the Watergate investigators. He is the 15th Watergate figure to go to jail, but the first to be asked whether Richard Nixon should join him in prison. (Dean refuses to comment.) Privately, Dean is shaken that Nixon is still insisting on his innocence. Later, Dean will write that he believes a number of reasons—hubris, victimization, self-pity, belief that history will exonerate him, and fear of jail—is all part of Nixon’s recalcitrance, but Dean does not believe that Nixon made a deal with President Ford for any sort of clemency. Dean will serve his term at Fort Holabird, a former army base just outside Baltimore used for government witnesses. Dean will mingle with three fellow Watergate convicts—Charles Colson, Jeb Stuart Magruder, and Herbert Kalmbach—and a number of organized crime figures in the government’s witness protection program. (Werth 2006, pp. 269-270) Colson, who has provided damning testimony against Nixon as part of his plea agreement (see June 1974), leads the others in reaching out to Dean in prison. Dean, who is held in relative isolation, briefly meets Magruder in the hallway. Magruder is preparing to testify against the “Big Three” of John Mitchell, John Ehrlichman, and H. R. Haldeman in their upcoming trial. Magruder says to Dean: “Welcome to the club, John. This place looks just like the White House with all of us here.” (Werth 2006, pp. 269-270)
Convicted Watergate burglar and former CIA operative E. Howard Hunt (see 2:30 a.m.June 17, 1972) denies that his requests for money from the Nixon White House ever amounted to blackmail or “hush money” (see Mid-November, 1972 and January 8-9, 1973). Writing in Harper’s magazine, Hunt says his situation was comparable to a CIA agent caught and incarcerated in a foreign country. Those agents, he says, are entitled to expect that the government will financially support their families and continue to pay their salaries until the agents are released.
Comparisons to CIA Agents Captured by Foreign Governments - He compares himself to American pilot Francis Gary Powers, whose U-2 surveillance plane was shot down over the Soviet Union during the Eisenhower administration, and who was financially supported by the government until his release. Another agent, John Downey, was kept prisoner for 20 years by China; when he returned, Hunt notes, he was paid twenty years’ worth of back salary. Hunt says that his situation is no different, and that not only was his efforts to secure large sums of cash from the Nixon administration understandable in the context of these captured intelligence agents, but something that should have been expected and handled without comment. “It was this time-honored understanding that for a time buoyed the hopes of the seven men who were indicted—and in two cases tried—for surreptitious entry into Democratic National Headquarters at the Watergate,” he writes. “That their attorneys’ fees were partially paid, that family living allowances were provided—and that these support funds were delivered by clandestine means—was to be expected.”
Dropoff of White House Support - He names then-Nixon campaign chairman John Mitchell, Mitchell’s deputy Jeb Magruder, and then-White House counsel John Dean as the “official sponsors of their project.” The fact that the White House and the CIA paid on Hunt’s demands “clearly indicates,” Hunt claims, “a perception on the Haldeman-Ehrlichman level of the appropriateness of clandestine support.” (H. R. Haldeman and John Ehrlichman were then-President Nixon’s top aides and closest confidantes.) It is only because “[a]s time passed, however, the burden of providing moneys was assumed by less sophisticated personnel” that Hunt’s “urgent requests for overdue support began to be interpreted as threats, i.e. ‘blackmail.’” He says that Dean and perhaps Nixon “misconstrued” the situation. Since there was no question that the “Watergate Seven” would be granted immunity from prosecution, “there was no question of buying silence, of suppressing the truth with ‘hush money.’” He concludes: “The Watergate Seven understood the tradition of clandestine support. Tragically for the nation, not all the president’s men were equally aware.” (Hunt 10/1974)
Conflict with Other Versions of Events - Hunt’s reconstruction of events directly clashes with others’ recollections and interpretations, as well as the facts themselves (see June 20-21, 1972, June 26-29, 1972, June 29, 1972, July 7, 1972, July 25, 1972, August 29, 1972, December 8, 1972, January 10, 1973, January 10, 1973, March 13, 1973, March 21, 1973, March 21, 1973, and July 5, 1974).
The research staff for British interviewer David Frost, preparing for his upcoming interviews with former President Richard Nixon (see Early 1976), receive two key documents from Leon Jaworski’s special prosecutor files (see November 1, 1973) that are, in essence, the government’s plan for questioning Nixon if he were to ever take the stand as a criminal defendant in federal court. One document is entitled “RMN [Richard Milhous Nixon] and the Money,” and concentrates on the March 21, 1973, conversation with then-White House counsel John Dean concerning Watergate burglar E. Howard Hunt’s demand for “hush money” (see Mid-November, 1972) and the attempts in the following weeks to explain away the payments to Hunt. The document is divided into five parts: Nixon’s statements about the money; Nixon’s knowledge of the payouts before March 21; the nature of the payment itself; the cover-up of Nixon’s role in the payout; and Nixon’s role in developing a defense against possible obstruction of justice charges. The second document cites excerpts from the June 20, 1972, conversations between Nixon and his then-senior aide Charles Colson (see June 20, 1972 and June 20, 1972). (Reston 2007, pp. 45-47)
The research staff for British interviewer David Frost, preparing for his upcoming interviews with former President Richard Nixon (see Early 1976), finds transcripts of two conversations between Nixon and his then-aide Charles Colson from February 1973 (see February 13, 1973 and February 14, 1973) in a batch of documents surrounding the prosecution of the Watergate burglars (see January 1, 1975). Former Watergate prosecutors Richard Ben-Veniste and George Frampton, informally advising the Frost research team, are both keenly interested in the transcripts. “You’ve got something no one else has,” Frampton says. “These transcripts must have been placed in the official exhibit by a clerical error.” The two explain the significance of the conversations between Nixon and Colson: they place Nixon directly in the plot to cover up the Watergate conspiracy six weeks before Nixon says he first learned of it. Frampton shows researcher James Reston Jr. just how he would have used the conversations against Nixon in court, while Ben-Veniste instructs Reston on how Frost should interrogate Nixon as a hostile witness. Frost should ask something like, “Is it still your position, Mr. Nixon, that between 21 March and 30 April, 1973, you acted to stop the cover-up and prosecute the guilty?” When Nixon answers yes, Frost should follow, “But in fact, as late as 16 April, 1973, you were working out ‘scenarios’ with Ehrlichman and Haldeman to make John Dean the Watergate scapegoat, weren’t you?” Other questions to ask include, “By what right were you offering campaign money for the defense of your associates who were charged in a criminal conspiracy?” and “Isn’t it really true that you never made any effort before 21 March to learn the details of a criminal activity that you knew was going on all around you?” (Reston 2007, pp. 50-51)
Secretary of Agriculture Earl Butz resigns after making a stridently racist joke that is reported in Rolling Stone. Butz, flying from New Mexico to California, found himself on board with singers Pat Boone and Sonny Bono as well as former Nixon White House counsel John Dean, now working as a reporter for Rolling Stone. Butz, whom Time magazine describes as a “gregarious man” with a “barnyard sense of humor,” wanders over to kibitz with Boone and Bono, both active in the Republican Party. When Boone asks why the Republicans aren’t able to attract more black voters, Butz responds: “I’ll tell you what the coloreds want. It’s three things. First, a tight p_ssy; second, loose shoes; and third, a warm place to sh_t.” Dean later reports the joke in his Rolling Stone column, without naming Butz as its source. (Interestingly, a Japanese newspaper sanitized the translation, reporting Butz as saying, “Blacks wanted only three things in life: pleasant family relations, comfortable footwear, and adequate toilet facilities.”) Before long, other media outlets have learned who said it, and Butz was revealed in the media as the perpetrator of the joke.
Ford Initially Defends Butz - President Ford does not immediately fire Butz because the secretary claims that his words were taken out of context; he claims that the joke was preceded with, “Things have come a long way since the days when a ward politician could say…” Ford considers Butz a friend and is reluctant to fire him outright; furthermore, Ford doesn’t want to alienate voters in key farm states. But when both Democrats and Republicans begin calling for Butz’s firing, Butz decides to resign. Butz tells reporters that he is not a racist, and that his resignation “is the price I pay for a gross indiscretion in a private conversation.” Time magazine later reports that Ford’s indecision costs him credibility and support—instead of doing the right thing when the time came, Ford seemed instead to merely cave under pressure. A top Ford aide later says, “I’m afraid some people will start wondering how straight a guy, how nice a fellow the president really is.” Ford loses little support in the farm states; although organizations like the American Farm Bureau Federation bemoan Butz’s resignation, smaller farmers rejoice in his departure, saying that he favored big producers and agribusiness interests over smaller, independent farmers. As for Butz himself, he is remarkably unrepentant and oblivious to the racial content of his humor. He will tell a reporter in the days to follow: “You know, I don’t know how many times I told that joke, and everywhere—political groups, church groups—nobody took offense, and nobody should. I like humor. I’m human.” (Time 10/18/1976; Reston 2007, pp. 54)
Casual Racism Mark of Butz's Breed of Politician - In February 2008, in a column marking Butz’s passing, Slate’s Timothy Noah will write that Butz was one of the last of a breed of politicians who routinely peppered their conversations with off-color, racist, and offensive remarks, certain that their power and position made them untouchable. Butz was certainly not the only one in the Nixon and Ford administration to make racist remarks: in 1971, President Nixon himself told Donald Rumsfeld, that blacks “basically are just out of the trees. Now let’s face it, they are.” (Nixon was wise enough not to make such remarks in public.) But by 1976, most lawmakers and office holders had learned to keep such observations to themselves. Noah will write: “Butz was not one of the smarter ones. He was a bigot and, even then, at 66, not a young man. And so he got caught in a paradigm shift. Before Butz, there remained a snickering tolerance among the powerful for jokes denigrating the humanity of blacks, Jews, and homosexuals. After Butz—well, the jokes about gays limped along for awhile, but it finally sank in that racism and anti-Semitism would seldom be tolerated, even in private.” (Noah 2/4/2008)
In his Watergate interview with former President Richard Nixon (see Early 1976 and April 13-15, 1977), David Frost continues from his earlier questioning about Nixon’s involvement in the Watergate conspiracy (see April 13, 1977) to the events of March 21, 1973 (see March 21, 1973). Now that Nixon’s status as a co-conspirator from the outset has been established, Frost wants to know why Nixon claims not to have known about the illegal aspects of the cover-up, or about the blackmail demands of Watergate burglar E. Howard Hunt, until this date. Nixon is cautious, claiming only that he learned of Hunt’s blackmail demands on March 21, and refusing to acknowledge that he knew anything about the $400,000 in payouts during the eight months preceding (see June 20-21, 1972).
Springing the Trap - Frost circles back, hoping for a flat confirmation: “So March 21 was the first day you learned about an illegal cover-up?” Nixon carefully says that March 21 was the day he learned of the “full import” of the cover-up, only having heard “smatterings” beforehand and being reassured by then-White House counsel John Dean that no White House personnel were involved. Frost springs his trap: “In that case, why did you say in such strong terms to [White House aide Charles] Colson on February 14, more than a month before, ‘The cover-up is the main ingredient, that’s where we gotta cut our losses. My losses are to be cut. The president’s losses got to be cut on the cover-up deal’” (see February 14, 1973). Nixon’s face betrays his shock. “Why did I say that?” he asks rhetorically, trying to gather himself. He fishes around for excuses, quickly settling on media reports at the time that tossed around charges of conspiracies, “hush money” payouts, and promises of executive clemency. That’s all he was referring to in the February 14 conversation, he says: the cover-up itself had to be avoided at all costs. Frost researcher James Reston, Jr. later writes, “It was an exquisite lie, a superb time warp.”
Error Goes Unnoticed - Only later do Reston and other research team members realize that no such stories had appeared in the media by February 14; in fact, allegations of a cover-up never made it into print until after burglar James McCord wrote his letter to Judge John Sirica on March 19 warning the judge of involvement of “higher-ups” in a conspiracy of silence (see March 19-23, 1973). No one had written publicly of any executive clemency deals until the subject was broached during the Senate Watergate investigative hearings (see February 7, 1973). But few of the millions who will see the interview will have the grasp of the chronology of events necessary to realize the extent of Nixon’s dishonesty.
Second Colson Bombshell - Frost reminds Nixon of his conversation with Colson of February 13 (see February 13, 1973), the day before, when they had discussed which Nixon official will have to take the fall for Watergate. Former campaign director John Mitchell couldn’t do it, the conversation went, but Nixon wants to know about Mitchell’s former deputy, Jeb Magruder. “He’s perjured himself, hasn’t he?” Nixon asked Colson. Frost asks Nixon, “So you knew about Magruder’s perjury as early as February the thirteenth?” Nixon bobs and weaves, talking about events from the year before, how Mitchell and Colson hated each other, how Colson and Ehrlichman hated each other. Frost brings Nixon back on point by reading another quote from the February 13 conversation, where Nixon says that “the problem” will come up if “one of the seven [indicted Watergate burglars] begins to talk…” Frost asks, “Now, in that remark, it seems to be that someone running the cover-up couldn’t have expressed it more clearly than that, could he?” Frost wants to know precisely what the phrase “one of the seven begins to talk” means. Nixon argues, but Frost refuses to be distracted. How can it mean anything else except “some sort of conspiracy to stop Hunt from talking about something damaging?” Frost asks. Nixon retorts, “You could state your conclusion, and I’ve stated my views.”
Nixon's Own Words Prove Knowledge, Complicity - Frost proceeds to pepper Nixon with his own quotes proving his knowledge and complicity, nine of them, a barrage that leaves Nixon nearly breathless. Nixon finally accuses Frost of taking his words out of context. Frost’s final quote is from an April 21 meeting where Nixon told aides John Dean and H. R. Haldeman, “Christ, just turn over any cash we got.” (Reston 2007, pp. 126-134) After the taping, Nixon asks his aides about the Colson transcripts: “What was that tape? I’m sure I never heard that tape before. Find out about that tape.” (Time 5/9/1977)
Former President Richard Nixon is nearly 20 minutes late for his second Watergate interview with David Frost (see April 13-15, 1977 and April 13, 1977). Neither Frost nor his team of researchers realize how rattled Nixon is from the last session. Frost begins the interview by asking about the so-called “Dean report” (see March 20, 1973), the results of John Dean’s “internal investigation” of the Watergate conspiracy. Dean’s report would have served two purposes: it would hopefully have removed suspicion from any White House officials as to their involvement in the conspiracy, and, if it was ever pulled apart and shown to be a compendium of lies and evasion, would have pointed to Dean as the central figure in the conspiracy. Dean never wrote the report, but instead became a witness for the prosecution (see April 6-20, 1973. June 3, 1973, and June 25-29, 1973). Since Dean never wrote the report, Frost asks Nixon why he told the deputy attorney general, Henry Peterson, that there was indeed such a report (Nixon had called it “accurate but not full”). Astonishingly, Nixon asserts that Dean did write the report, and that it indeed showed no “vulnerability or criminality on the part of the president… so let’s not get away from that fact.” Frost sees Nixon’s vulnerability. Frost asks when he read the report. Caught, Nixon backs off of his assertion, saying that he “just heard that ah… that he had written a report… ah… the… that… ah… he… ah… ah, considered it to be inadequate.” Frost researcher James Reston, Jr. later writes, “[Nixon] was firmly skewered. His face showed it. His gibberish confirmed it.”
Ehrlichman's Report - Frost moves on to another report on Watergate by former aide John Ehrlichman, the so-called “modified, limited hangout,” and the offer of $200,000 in cash to Ehrlichman and fellow aide H. R. Haldeman for their legal fees. Nixon had told the nation that Ehrlichman would produce an informative and factual report on Watergate, even though he knew by then that Ehrlichman was himself heavily involved in the conspiracy (see August 15, 1973). “That’s like asking Al Capone for an independent investigation of organized crime in Chicago,” Frost observes. “How could one of the prime suspects, even if he was the Pope, conduct an independent inquiry?” Instead of answering the question, Nixon ducks into obfuscation about what exactly constitutes a “prime suspect.”
Nixon Begins to Crack - Reston later writes that, looking back on the interview, it is at this point that Nixon begins to “crack” in earnest. Frost has cast serious doubts on Nixon’s veracity and used Nixon’s own words and actions to demonstrate his culpability. Now Frost asks a broader question: “I still don’t know why you didn’t pick up the phone and tell the cops. When you found out the things that Haldeman and Ehrlichman had done, there is no evidence anywhere of a rebuke, but only of scenarios and excuses.” Nixon responds with what Reston calls a long, “disjointed peroration… about Richard the Isolated and Richard the Victimized… Nixon was desperate to move from fact to sentiment.” But Nixon is not merely rambling. Woven throughout are mentions of the guilt of the various White House officials (but always others, never Nixon’s own guilt), apology, mistakes and misjudgments. Clearly he is hoping that he can paint himself as a sympathetic figure, victimized by fate, bad fortune, and the ill will of his enemies. (Haldeman is so outraged by this stretch that he will soon announce his intention to tell everything in a book—see February 1978; Ehrlichman will call it a “smarmy, maudlin rationalization that will be tested and found false.”) Nixon says he merely “screwed up terribly in what was a little thing [that] became a big thing.”
Crossroads - Frost tries to ease an admission of complicity from Nixon—perhaps if hammering him with facts won’t work, appealing to Nixon’s sentimentality will. “Why not go a little farther?” Frost asks. “That word mistake is a trigger word with people. Would you say to clear the air that, for whatever motives, however waylaid by emotion or whatever you were waylaid by, you were part of a cover-up?” Nixon refuses. Behind the cameras, Nixon staffer Jack Brennan holds up a legal pad with the message “LET’S TALK” (or perhaps “LET HIM TALK”—Reston’s memory is unclear on this point). Either way, Frost decides to take a short break. Brennan hustles Reston into a room, closes the door, and says, “You’ve brought him to the toughest moment of his life. He wants to be forthcoming, but you’ve got to give him a chance.” He wouldn’t confess to being part of a criminal conspiracy, and he wouldn’t admit to committing an impeachable offense. Nixon’s staff has been arguing for days that Nixon should admit to something, but Brennan and Reston cannot agree as to what. Reston later writes that Nixon is at a personal crossroads: “Could he admit his demonstrated guilt, express contrition, and apologize? Two years of national agony were reduced to the human moment. Could he conquer his pride and his conceit? Now we were into Greek theater.” When the interview resumes, Nixon briefly reminisces about his brother Arthur, who died from meningitis at age seven. Was Frost using the story of his brother to open Nixon up? “We’re at an extraordinary moment,” Frost says, and dramatically tosses his clipboard onto the coffee table separating the two men. “Would you do what the American people yearn to hear—not because they yearn to hear it, but just to tell all—to level? You’ve explained how you got caught up in this thing. You’ve explained your motives. I don’t want to quibble about any of that. Coming down to sheer substance, would you go further?” Nixon responds, “Well, what would you express?” Reston will later write, “Every American journalist I have ever known would shrivel at this plea for help, hiding with terror behind the pose of the uninvolved, ‘objective’ interviewer. The question was worthy of Socrates: Frost must lead Nixon to truth and enlightenment.” Frost gropes about a bit, then lists the categories of wrongdoing. First, there were more than mere mistakes. “There was wrongdoing, whether it was a crime or not. Yes, it may have been a crime, too. Two, the power of the presidency was abused. The oath of office was not fulfilled. And three, the American people were put through two years of agony, and… I think the American people need to hear it. I think that unless you say it, you’re going to be haunted for the rest of your life…”
Apology and Admission - Nixon’s response is typically long, prefaced with a rambling discussion of his instructions to speechwriter Ray Price to include his own name with those of Haldeman’s and Ehrlichman’s in the speech announcing their resignations “if you think I ought to” (see April 29, 1973), a litany of all the good things he did while president, and a short, bitter diatribe against those who had sought to bring him down. He never committed a crime, he insists, because he lacked the motive for the commission of a crime.
Terrible Mistakes - But all this is prelude. Nixon shifts to the core of the issue: he had made terrible mistakes not worthy of the presidency. He had violated his own standards of excellence. He deliberately misled the American people about Watergate, he admits, and now he regrets his actions. His statements were not true because they did not go as far as they should have, and “for all of those things I have a deep regret… I don’t go with the idea that what brought me down was a coup, a conspiracy. I gave ‘em the sword. They stuck it in and twisted it with relish. I guess if I’d been in their position, I’d’a done the same thing.” Nixon will not, or perhaps cannot, plainly admit that he broke the law in working to conceal the facts surrounding Watergate, but he does admit that after March 21, 1973, he failed to carry out his duties as president and went to “the edge of the law.… That I came to the edge, I would have to say that a reasonable person could call that a cover-up.” Reston notes that Nixon has just admitted to a standard of guilt high enough for a civil court if not a criminal court. But Nixon isn’t done. (Reston 2007, pp. 137-155)
Calls Resigning a 'Voluntary Impeachment' - “I did not commit, in my view, an impeachable offense,” he says. “Now, the House has ruled overwhelmingly that I did. Of course, that was only an indictment, and it would have to be tried in the Senate. I might have won, I might have lost. But even if I had won in the Senate by a vote or two, I would have been crippled. And in any event, for six months the country couldn’t afford having the president in the dock in the United States Senate. And there can never be an impeachment in the future in this country without a president voluntarily impeaching himself. I have impeached myself. That speaks for itself.” Resigning the presidency (see August 8, 1974), he says, was a “voluntary impeachment.” (Guardian 9/7/2007)
Reactions - Frost and his researchers are stunned at Nixon’s statements, as will the millions be who watch the interview when it is broadcast. (Reston 2007, pp. 137-155) In 2002, Frost will recall, “I sensed at that moment he was most the vulnerable he’d ever be, ever again. It seemed like an almost constitutional moment with his vulnerability at that point.… I hadn’t expected him to go as far as that, frankly. I thought he would have stonewalled more at the last stage. I think that was probably one of the reasons why it was something of a catharsis for the American people at that time that he had finally faced up to these issues, not in a court of law, which a lot of people would have loved to have seen him in a court of law, but that wasn’t going to happen. So—he’d been pardoned. But faced up in a forum where he was clearly not in control and I think that’s why it had the impact it did, probably.” (National Public Radio 6/17/2002) Not everyone is impressed with Nixon’s mea culpa; the Washington Post, for one, writes, “He went no further than he did in his resignation speech two and a half years ago,” in a story co-written by Watergate investigative reporter Bob Woodward. (Segal 4/30/2007) This interview will air on US television on May 26, 1977. (Steele 5/27/1977)
Former Nixon aide H. R. Haldeman, in his autobiography The Ends of Power, advances his own insider theory of the genesis of the Watergate burglaries (see July 26-27, 1970). Haldeman, currently serving a one-year prison sentence for perjuring himself during his testimony about the Watergate cover-up, became so angered while watching David Frost interview former President Nixon, and particularly Nixon’s attempts to pin the blame for Watergate on Haldeman and fellow aide John Ehrlichman (see April 15, 1977), that he decided to write the book to tell his version of events. Some of his assertions:
Nixon, Colson Behind 'Plumbers;' Watergate Burglary 'Deliberately Sabotaged' - He writes that he believes then-President Nixon ordered the operation that resulted in the burglaries and surveillance of the Democratic National Committee (DNC) headquarters because he and Charles Colson, the aide who supervised the so-called “Plumbers” (see Late June-July 1971), were both “infuriated with [DNC chairman Lawrence] O’Brien’s success in using the ITT case against them” (see February 22, 1972). Colson, whom Haldeman paints as Nixon’s “hit man” who was the guiding spirit behind the “Plumbers,” then recruited another White House aide, E. Howard Hunt, who brought in yet another aide, G. Gordon Liddy. Haldeman goes into a more interesting level of speculation: “I believe the Democratic high command knew the break-in was going to take place, and let it happen. They may even have planted the plainclothesman who arrested the burglars. I believe that the CIA monitored the Watergate burglars throughout. And that the overwhelming evidence leads to the conclusion that the break-in was deliberately sabotaged.” O’Brien calls Haldeman’s version of events “a crock.” As for Haldeman’s insinuations that the CIA might have been involved with the burglaries, former CIA director Richard Helms says, “The agency had nothing to do with the Watergate break-in.” Time magazine’s review of the book says that Haldeman is more believable when he moves from unverifiable speculation into provable fact. One such example is his delineation of the conspiracy to cover up the burglaries and the related actions and incidents. Haldeman writes that the cover-up was not a “conspiracy” in the legal sense, but was “organic,” growing “one step at a time” to limit political damage to the president.
Story of Kennedy Ordering Vietnamese Assassination Actually True - He suggests that the evidence Hunt falsified that tried to blame former president John F. Kennedy of having then-South Vietnamese President Ngo Dinh Diem assassination (see Mid-September 1971) may have pointed to the actual truth of that incident, hinting that Kennedy may have ordered the assassination after all.
US Headed Off Two Potentially Catastrophic Nuclear Incidents with USSR, China - He also writes of a previously unsuspected incident where Nixon and other US officials convinced the Soviets not to attack Chinese nuclear sites. And Haldeman tells of a September 1970 incident where the US managed to head off a second Cuban Missile Crisis. Both stories of US intervention with the Soviets are strongly denied by both of Nixon’s Secretaries of State, Henry Kissinger, and William Rogers.
Duality of Nixon's Nature - Haldeman says that while Nixon carried “greatness in him,” and showed strong “intelligence, analytical ability, judgment, shrewdness, courage, decisiveness and strength,” he was plagued by equally powerful flaws. Haldeman writes that Nixon had a “dirty, mean, base side” and “a terrible temper,” and describes him as “coldly calculating, devious, craftily manipulative… the weirdest man ever to live in the White House.” For himself, Haldeman claims to have always tried to give “active encouragement” to the “good” side of Nixon and treat the “bad” side with “benign neglect.” He often ignored Nixon’s “petty, vindictive” orders, such as giving mass lie detector tests to employees of the State Department as a means of finding security leaks. He writes that while he regrets not challenging Nixon more “frontally” to counter the president’s darker impulses, he notes that other Nixon aides who had done so quickly lost influence in the Oval Office. Colson, on the other hand, rose to a high level of influence by appealing to Nixon’s darker nature. Between the two, Haldeman writes, the criminal conspiracy of Watergate was created. (Colson disputes Haldeman’s depiction of his character as well as the events of the conspiracy.) Haldeman himself never intended to do anything illegal, denies any knowledge of the “Gemstone” conspiracy proposal (see January 29, 1972), and denies ordering his aide Gordon Strachan to destroy evidence (see June 18-19, 1972).
Reconstructing the 18 1/2 Minute Gap - Haldeman also reconstructs the conversation between himself and Nixon that was erased from the White House tapes (see June 23, 1972 and July 13-16, 1973). Time notes that Haldeman reconstructs the conversation seemingly to legally camouflage his own actions and knowledge, “possibly to preclude further legal charges against him…” According to Haldeman’s reconstruction, Nixon said, “I know one thing. I can’t stand an FBI interrogation of Colson… Colson can talk about the president, if he cracks. You know I was on Colson’s tail for months to nail Larry O’Brien on the [Howard] Hughes deal (see April 30 - May 1, 1973; O’Brien had worked for Hughes, and Nixon was sure O’Brien had been involved in illegalities). Colson told me he was going to get the information I wanted one way or the other. And that was O’Brien’s office they were bugging, wasn’t it? And who’s behind it? Colson’s boy Hunt. Christ. Colson called [deputy campaign chief Jeb Magruder] and got the whole operation started. Right from the g_ddamn White House… I just hope the FBI doesn’t check the office log and put it together with that Hunt and Liddy meeting in Colson’s office.” Time writes, “If the quotes are accurate, Nixon is not only divulging his own culpability in initiating the bugging but is also expressing a clear intent to keep the FBI from learning about it. Thus the seeds of an obstruction of justice have been planted even before the celebrated June 23 ‘smoking gun’ conversation, which ultimately triggered Nixon’s resignation from office.” Haldeman says he isn’t sure who erased the tape, but he believes it was Nixon himself. Nixon intended to erase all the damning evidence from the recordings, but since he was, Haldeman writes, “the least dexterous man I have ever known,” he quickly realized that “it would take him ten years” to erase everything.
'Smoking Gun' Allegations - Haldeman also makes what Time calls “spectacular… but unverified” allegations concerning the June 23, 1972 “smoking gun” conversations (see June 23, 1972). The focus of that day’s discussion was how the White House could persuade the CIA to head off the FBI’s investigation of the Watergate burglary. The tape proved that Nixon had indeed attempted to block the criminal investigation into Watergate, and feared that the money found on the burglars would be traced back to his own re-election campaign committee. Haldeman writes that he was confused when Nixon told him to tell the CIA, “Look, the problem is that this will open up the whole Bay of Pigs thing again.” When Haldeman asked Helms to intercede with the FBI, and passed along Nixon’s warning that “the Bay of Pigs may be blown,” Helms’s reaction, Haldeman writes, was electric. “Turmoil in the room, Helms gripping the arms of his chair, leaning forward and shouting, ‘The Bay of Pigs had nothing to do with this. I have no concern about the Bay of Pigs.’” Haldeman writes, “I was absolutely shocked by Helms‘[s] violent reaction. Again I wondered, what was such dynamite in the Bay of Pigs story?” Haldeman comes to believe that the term “Bay of Pigs” was a reference to the CIA’s secret attempts to assassinate Cuban dictator Fidel Castro. The CIA had withheld this info from the Warren Commission, the body that investigated the assassination of President Kennedy, and Haldeman implies that Nixon was using the “Bay of Pigs thing” as some sort of blackmail threat over the CIA. Haldeman also hints, very vaguely, that Nixon, when he was vice president under Dwight D. Eisenhower, was a chief instigator of the actual Bay of Pigs invasion. (Time notes that while Vice President Nixon probably knew about the plans, “he certainly had not been their author.”)
Other Tidbits - Haldeman writes that Nixon’s taping system was created to ensure that anyone who misrepresented what Nixon and others said in the Oval Office could be proven wrong, and that Nixon had Kissinger particularly in mind. Nixon kept the tapes because at first he didn’t believe he could be forced to give them up, and later thought he could use them to discredit former White House counsel John Dean. He says Nixon was wrong in asserting that he ordered Haldeman to get rid of the tapes. Haldeman believes the notorious “deep background” source for Washington Post reporters Carl Bernstein and Bob Woodward was actually Fred Fielding, Dean’s White House deputy. Interestingly, Haldeman apparently discovered the real identity of “Deep Throat” in 1972 to be senior FBI official W. Mark Felt (see October 19, 1972). It is unclear why Haldeman now writes that Fielding, not Felt, was the Post source.
Not a Reliable Source - Time notes that Haldeman’s book is far from being a reliable source of information, characterizing it as “badly flawed, frustratingly vague and curiously defensive,” and notes that “[m]any key sections were promptly denied; others are clearly erroneous.” Time concludes, “Despite the claim that his aim was finally to ‘tell the truth’ about the scandal, his book is too self-protective for that.” And it is clear that Haldeman, though he writes how the cover-up was “morally and legally the wrong thing to do—so it should have failed,” has little problem being part of such a criminal conspiracy. The biggest problem with Watergate was not that it was illegal, he writes, but that it was handled badly. He writes, “There is absolutely no doubt in my mind today that if I were back at the starting point, faced with the decision of whether to join up, even knowing what the ultimate outcome would be, I would unhesitatingly do it.” (Time 2/27/1978; Spartacus Schoolnet 8/2007)
Samuel Loring Morison is prosecuted by the Justice Department for providing classified pictures of a Soviet nuclear-powered aircraft carrier to Jane’s Defense magazine. Morison, a naval intelligence analyst specializing in Soviet amphibious and mine-laying vessels, works part time for Jane’s, and has been warned about potential conflicts of interest. Part of Morison’s motives for passing classified information to the magazine is his belief that the US citizenry, if they knew about the carrier, would demand to “increase the defense budget.” Even though the Justice Department itself acknowledges that Morison did nothing to threaten national security, it successfully prosecutes him under the 1917 Espionage Act. Morison will serve a two-year prison sentence.
Commentary - Former Nixon White House aide John Dean will write in 2004 that if the same standard used to prosecute Morison were to be more widely applied, “several presidents and secretaries of state could have been prosecuted for information in their memoirs.” Before Morison, no one had ever been prosecuted for publishing leaked information. In Dean’s view, Morison is prosecuted under a standard more appropriate to Britain’s Official Secrets Act, not any applicable US law, and is a victim of the worst kind of selective law enforcement. Thirty-four amicus curiae briefs will be filed on Morison’s behalf, from a host of newspapers, television news networks, and news media trade and professional associations.
Pardon - In 1998, Senator Daniel Moynihan (D-NY) will call Morison’s conviction an “anomaly,” the only one of its kind in 81 years, and ask President Clinton to pardon Morison. He will write, “What is remarkable is not the crime, but that [Morison] is the only one convicted of an activity which has become a routine aspect of government life: leaking information to the press in order to bring pressure to bear on a policy question.” Clinton will grant the pardon in 2001. (Daniel Patrick Moynihan 9/29/1998; Research Foundation of the University of Texas A&M 1/21/2003; Dean 2004, pp. 66-67, 221)
Associate Justice William Rehnquist becomes Chief Justice of the Supreme Court. A strict conservative, Rehnquist will oversee the transformation of the Court from a middle-of-the-road, sometimes left-leaning instrument into a conservative entity dominated by the “axis” of Rehnquist, Antonin Scalia (see September 26, 1986), and Clarence Thomas (see July 2-August 28, 1991). False Testimony? - According to former Nixon White House counsel John Dean, writing in his 2007 book Broken Government, Rehnquist is the first true conservative fundamentalist to be appointed to the Court, “and he would set a pattern for other fundamentalists who found it necessary to make their way through the confirmation process by deception.” Dean, and others, have alleged that Rehnquist lied to the Senate both in his 1971 appointment to the Court as an associate judge (see January 7, 1972) and in his 1986 hearings for becoming chief justice. Dean will write that Rehnquist’s testimony during both sets of Senate confirmations hearings was “conspicuously false,” and in 1986 he committed “pure perjury.” In both sets of hearings, Rehnquist was embarrassed by a 1952 memo he had written while clerking for then-Justice Robert Jackson, in which Rehnquist had urged Jackson not to vote in support of the Brown v. Board of Education verdict that overturned the “separate but equal” clause that allowed for state-sponsored segregation. Although it is clear Rehnquist was stating his own pro-segregationist views, he apparently lied to the Senate over this memo as well, claiming that the memo was written to reflect Jackson’s own views and not his own. Dean will write, “It was an absurd contention, and a defamation of the dead justice for which he worked.” Law professor Laura Ray will observe in 1996: “With the [top] seat on the Supreme Court almost in his grasp, Rehnquist may well have retreated from an uncomfortable position taken almost twenty years earlier in the only way that seemed open to him. That such a step might tarnish the reputation of Justice Jackson years after his death does not seem to have been a concern.” (Dean 2007, pp. 129-137)
The controversial nomination of conservative judge Robert Bork to the Supreme Court is defeated in the US Senate. Bork is denied a seat on the Court in a 58-42 vote, because his views are thought to be extremist and even some Republicans vote against him.
'Right-Wing Zealot' - Bork, nominated by President Reagan as one of the sitting judges who most completely reflects Reagan’s judiciary philosophy (see 1985-1986), is characterized even by administration officials as a “right-wing zealot.” Reagan also wants a nominee to placate the hard right over their disaffection caused by the brewing Iran-Contra scandal. However, to make him more palatable for the majority of Americans, Reagan officials attempt to repackage Bork as a moderate conservative. Senate Judiciary Committee member Edward Kennedy (D-MA) attacks Bork’s political philosophy, saying before the committee hearings: “[In Bork’s America] women would be forced into back alley abortions, blacks would sit at segregated lunch counters, rogue police could break down citizens’ doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists could be censored at the whim of government, and the doors of the federal courts would be shut on the fingers of millions of citizens for whom the judiciary is the—and is often the only—protector of the individual rights that are the heart of our democracy.… No justice would be better than this injustice.” Kennedy’s words provoke complaint, but the characterization of Bork is based on his lengthy record of court verdicts and his large body of judicial writings.
Racial Equality Issues - Although there is no evidence to suggest that Bork is himself a racist, former Nixon White House counsel John Dean will write that “his positions on civil rights were an anathema to all who cared about equality in America.” Constitutional law professor Herman Schwartz will write in 2004, “Bork condemned the Fourteenth Amendment’s Equal Protection Clause decisions outlawing the poll tax (to him it was just ‘a very small tax’), the decision establishing the one-person, one-vote principle, abolishing school segregation in the District of Columbia, barring courts from enforcing racially restrictive housing covenants, preventing a state from sterilizing certain criminals or interfering with the right to travel, and prohibiting discrimination against out-of-wedlock children…. Bork’s hostility to governmental action on behalf of minorities did not stop with his critique of court action. In 1963 he criticized a section of the proposed Civil Rights Act of 1964 that required white businesses to serve blacks as resting on a principle of ‘unsurpassed ugliness.’”
Ready to Fight - The Reagan administration understands that Bork’s nomination is opposed; on July 1, the day of his announced nomination, the media reports that Reagan will try to ensure Bork’s confirmation by waging an “active campaign.” Even Senate-savvy James Baker, Reagan’s chief of staff, is uncertain about Bork’s chances at being confirmed, and further worries that even if Bork wins the fight, the cost to Reagan’s political capital will be too high.
His Own Worst Enemy - Conservatives Justice Department official Terry Eastland will later say Senate Democrats sabotage Bork’s chances at faring well in the confirmation hearings, even positioning his table to ensure the least favorable angles for Bork on television. However, the public’s opinion of Bork is unfavorable, and Dean will write: “[I]t was not the position of his chair in the hearing room that made Bork look bad, but rather his arrogance, his hubris, and his occasional cold-bloodedness, not to mention his equivocations and occasional ‘confirmation conversions,’ where he did what no one else could do. He made himself a terrible witness who did not appear to be truthful.” The confirmation conversions even surprise some of his supporters, as Bork abandons his previous stances that the First Amendment only applies to political speech, and the Fourteenth Amendment’s equal protection clause does not apply to women. The Senate Judiciary Committee passes Bork’s nomination along to the full Senate, where Bork is defeated 58-42.
The Verb 'To Bork' - In 2007, Dean will write, “Bork’s defeat made him both a martyr and a verb,” and quotes conservative pundit William Safire as writing that “to bork” someone means to viciously attack a political figure, particularly by misrepresenting that figure in the media. (Dean 2007, pp. 137-143)
Representative Dick Cheney (R-WY) publishes an essay for the neoconservative American Enterprise Institute (AEI), apparently written either by his Iran-Contra commission colleague Michael Malbin or by Cheney and Malbin together, but printed under Cheney’s name. The essay is titled “Congressional Overreaching in Foreign Policy,” and covers what he terms “congressional aggrandizement” of presidential powers.
Congress Has No Place in Determining, Implementing US Foreign Policy - Cheney’s essay bluntly states his belief that Congress has no business interfering in the president’s power to determine and implement the nation’s foreign policy; in general, the essay indicates Cheney’s disdain for the legislative branch of which he has been a member. He writes, in part: “Broadly speaking, the Congress was intended to be a collective, deliberative body. When working at its best, it would slow down decisions, improve their substantive content, subject them to compromise, and help build a consensus behind general rules before they were to be applied to the citizenry. The presidency, in contrast, was designed as a one-person office to ensure that it would be ready for action. Its major characteristics… were to be ‘decision, activity, secrecy, and dispatch.‘… [T]he legislative branch is ill equipped to handle many of the foreign policy tasks it has been taking upon itself lately.” He writes that while Congress may take upon itself powers to launch military actions or respond to an attack, it is by nature so slow and deliberative, and its members so focused on getting reelected, that it cannot adequately wield those powers: “[T]he real world effect often turns out… not to be a transfer of power from the president to Congress, but a denial of power to the government as a whole.” The only power Congress should have in involving itself in foreign policy, Cheney argues, is whether or not to fund presidential initiatives. “[T]he nation should not be paralyzed by Congress’s indecision,” he writes. Cheney Selected as Secretary of Defense - Shortly after the essay is published, President George H.W. Bush names Cheney as his secretary of defense. Cheney was scheduled to give a talk based on the essay at AEI, but cancels it and goes to Washington to begin preparing for confirmation hearings in the Senate. Reporter Charlie Savage will note that the essay may have caused Cheney some difficulties in his confirmation hearings had it had a larger audience. (Savage 2007, pp. 61)
Former White House Counsel: Cheney's Proposals Unconstitutional, Unwise - In 2007, former Nixon White House counsel John Dean will write of the essay: “Cheney seems to be oblivious to the fact that the type of government he advocates is not, in fact, the government our Constitution provides.… His argument also assumes that a more agile, energetic, and fast-acting chief executive is the better system, but history does not support that contention. Presidential leadership has consistently shown itself less wise and less prudent than the slower but more deliberative nature of the system that we have. It was Congress that forced presidents out of no-win wars like Vietnam. The reason the nation’s Founders empowered Congress was because they wisely realized that a president—like heads of governments throughout history—was prone to fighting wars for his own glory, without seeming able to easily bring those wars to an end.” (Dean 2007, pp. 88-89)
Former Solicitor General Erwin Griswold, who represented the United States before the Supreme Court in the landmark Pentagon Papers case in 1971 (see March 1971 and June 30, 1971), now writes that he saw nothing in those documents that threatened national security. In 1971, without ever actually reading the documents, Griswold argued that their publication constituted a “grave and immediate danger to the security of the United States.” Griswold writes in a Washington Post op-ed that he relied on the judgment of “three high officials, one each from the Defense Department, the State Department and the National Security Agency” to explain to him why the documents posed such a threat. (In 2006, then-White House counsel John Dean will write that Griswold “did not insist on knowing what was actually contained in the Pentagon Papers, and he never found out, even as he insisted on the importance of their continued secrecy.”) In 1971, Griswold told the Court: “I haven’t the slightest doubt myself that the material which has already been published and the publication of the other materials affects American lives and is a thoroughly serious matter. I think to say that it can only be enjoined if there will be a war tomorrow morning, when there is a war now going on, is much too narrow.” Griswold now writes: “I have never seen any trace of a threat to the national security from the publication [of the documents]. Indeed, I have never seen it even suggested that there was such an actual threat.… It quickly becomes apparent to any person who has considerable experience with classified material that there is massive overclassification and that the principal concern of the classifiers is not with national security, but rather with governmental embarrassment of one sort or another.” (Griswold 2/15/1989; Dean 6/16/2006; Siegel 2008, pp. 200)
Iraq invades Kuwait. In response, the US suspends National Security Directive 26 (see October 2-6, 1989), which established closer ties with Baghdad and mandated $1 billion in agricultural loan guarantees to Iraq. (Frantz and Waas 2/23/1992) The secretary of defense, Dick Cheney, begins pressing President Bush to go to war with Iraq without securing Congressional approval. His rationale is two-fold: he doesn’t need Congressional authority, and he might not get it if he asks. Cheney moves the Pentagon onto a full war footing, even going so far as to create what author and former White House counsel John Dean calls “his own concocted high-risk plans of battle, which he tried but failed to sell at the White House.” Bush will juggle Cheney’s view with that of House Speaker Tom Foley, who will give the president a document signed by 81 Democratic members who insist that if Bush wants to go to war, he needs the authorization of Congress. Dean will write that Cheney’s arguments “are based on bogus legal and historical arguments that have been made before, but no one has pushed them longer or harder than he has.” (Dean 2007, pp. 89-91) Bush decides not to follow Cheney’s advice. In 2007, author and reporter Charlie Savage will observe: “By urging Bush to ignore the War Powers Resolution on the eve of the first major overseas ground war since Congress enacted the law, Cheney was attempting to set a powerful precedent. Had Bush taken his advice and survived the political fallout, the Gulf War would have restored [former President] Truman’s claim that as president he had ‘inherent’ powers to send American troops to the Korean War on his own” (see June 30, 1950). (Savage 2007, pp. 62)
Defense Secretary Dick Cheney testifies to the Senate on the upcoming invasion of Iraq (see August 2, 1990). Senator Ted Kennedy (D-MA) asks Cheney bluntly, “Now, barring an act of provocation, do you agree that the president must obtain the approval of Congress in advance before the United States attacks Iraq?” Cheney replies that he “does not believe the president requires any additional authorization from the Congress before committing US forces to achieve our objectives in the Gulf.” Cheney cites “more than two hundred” earlier instances where presidents have committed US forces into conflicts, “and on only five of those occasions was their a prior declaration of war. And so I am not one who would argue… that the president’s hands are tied, or that he is unable, given his constitutional responsibilities as commander in chief, to carry out his responsibilities.” Author John Dean will note in 2007, “Cheney had announced to Congress, in essence, that he did not need their authority to go to war.” Kennedy says of Cheney’s statement after the hearings, “We’ve not seen such arrogance in a president since Watergate.” (Dean 2007, pp. 90)
Faced with a lawsuit from 53 members of Congress demanding that he seek Congressional authorization before invading Iraq (see December 1990 and January 16, 1991 and After), President Bush asks Congress for such an authorization. His carefully worded request does not directly acknowledge the constitutional requirement that Congress authorize any military involvement by the US. After three days of what the New York Times calls “solemn, often eloquent debate,” both chambers of Congress approve the war resolution. (PBS Frontline 1/9/1996; Dean 2007, pp. 90-91) That authority is granted in part because of propaganda efforts mounted by Pentagon and Kuwaiti officials (see October 10, 1990). Even with such powerful persuasive tactics, the vote in the US Senate is 52-47 and 250-183 in the US House of Representatives, the closest such vote since the War of 1812. (NationMaster 12/23/2007)
House Reminds Bush that Congress Retains Power to Declare War - The House passes another resolution, 302-131, informing the White House that Congress has the exclusive authority under the Constitution to declare war. Of this second resolution, author and former Nixon White House counsel John Dean will write in 2007, “The breakdown of the vote is telling: 260 Democrats and 41 Republicans along with one independent voted to support the wording and clear intention of Article I of the Constitution; 126 Republicans and 5 Democrats, all hard-right conservatives (including Tom DeLay, R-TX, and two would-be presidents of the United States, Newt Gingrich, R-GA and Duncan Hunter, R-CA) voted against the resolution.” (Dean 2007, pp. 90-91)
Gore Persuaded to Support War by Wilson - One of the few Democratic senators to vote for the war is Al Gore (D-TN). Gore takes time from the floor deliberations to speak with the ranking US diplomat in Iraq, Joseph Wilson, who once served as Gore’s aide (see September 5, 1988 and After). Gore grills Wilson for twenty minutes on the efficacy of US sanctions against Iraq (see August 6, 1990) and the necessity of US intervention to free Kuwait before returning to the Senate to vote for the authorization. Wilson later writes of his outrage that Gore’s fellow senator, Alan Simpson (R-WY), would accuse Gore during the 2000 election of being what Simpson will call “Prime Time Al” for the timing of his speech in favor of the war authorization. Wilson recalls Simpson as the senator who had been “practically on bended knee before Saddam in April 1990, reassuring the Iraqi dictator that he had a press problem and not a policy problem” (see April 12, 1990). Wilson will continue, “It was an outrage that a decade later he had the nerve to be critical of the one senator who had really taken the time to listen to an analysis from the field and factor that into his decision on what most senators agreed was one of the most momentous votes of their careers.” (Wilson 2004, pp. 163-164)
Former White House counsel John Dean, shocked by allegations that he was behind the Watergate burglary in an attempt to prove that Democrats were involved in a prostitution ring (see May 6, 1991), calls Hays Gorey, a reporter with Time magazine who co-authored a book with Dean’s wife Maureen about her experiences during Watergate. Gorey is shocked that Time is considering running an article on the allegations without conferring with him, as Gorey had anchored much of Time’s Watergate coverage at the time. Both he and Dean are stunned to see that Maureen Dean is accused of being connected to the so-called prostitution ring; Gorey calls the allegations complete fantasy. Gorey learns that Time has secured the rights to print portions of the not-yet-published book making the allegations, Silent Coup. Dean later writes that his wife finds the allegations “laughable,” and is completely certain that her former roommate, Heidi Rikan, never ran any prostitution ring, as the book alleges. She has no knowledge of an attorney named Philip Macklin Bailey, whom, the book’s authors claim, was connected to the supposed prostitution ring, and had her name as well as Dean’s in his address book. By the end of the day, the producers of CBS’s 60 Minutes have decided not to air a segment on the book, as neither the authors nor the book’s publisher can provide any proof of their allegations. Bailey is “unavailable” and the authors either cannot or will not provide any documentation to back up their claims. Time, however, still intends to publish an excerpt from the book and a review. Time’s editors ask Gorey to interview Dean for a sidebar article; by this point, Gorey has talked to numerous members of the Democratic National Committee (DNC) from 1972, and they all say that the allegation of the DNC either operating or patronizing a prostitution ring is absolute fiction. (One former DNC official tells Gorey that had the committee patronized such a ring, he would have been a regular customer.) Gorey loans Dean his advance copy of the book, and after skimming over it, Dean, writing in 2006, concludes that the book is “filled with false or misleading information. All the hard evidence (the information developed by government investigators and prosecutors) that conflicted with this invented story was simply omitted.” Dean and Gorey both wonder why St. Martin’s Press and Time believe they can publish such outlandish accusations without facing lawsuits. (Dean 2006, pp. xvii-xviii)
Former White House counsel John Dean, who served prison time for his complicity in the Watergate conspiracy (see September 3, 1974), receives an early morning phone call from CBS reporter Mike Wallace. Dean has tried to keep a low public profile for over a decade, focusing on his career in mergers and acquisitions and staying out of politics. Wallace wants Dean’s reaction to a not-yet-published book by Leonard Colodny and Robert Gettlin, Silent Coup, which advances a very different theory about the Watergate affair than is generally accepted. According to Dean’s own writing and a Columbia Journalism Review article about the book, the book’s allegations are as follows:
Richard Nixon was guilty of nothing except being a dupe. Instead, Dean is the mastermind behind the Watergate conspiracy. Dean became involved both to find embarrassing sexual information on the Democrats and to protect his girlfriend, Maureen “Mo” Biner (later his wife), who is supposedly listed in a notebook linked to a prostitution ring operating out of the Watergate Hotel. This alleged prostitution ring was, the authors assert, patronized or even operated by officials of the Democratic Party. Dean never told Nixon about the prostitution ring, instead concocting an elaborate skein of lies to fool the president. According to the authors, Dean’s wife Maureen knew all about the call girl ring through her then-roommate, Heidi Rikan, whom the authors claim was actually a “madame” named Cathy Dieter. The address book belonged to a lawyer involved in the prostitution ring, Philip Macklin Bailey.
According to the book, the other schemer involved in Watergate was Nixon’s chief of staff Alexander Haig. Haig wanted to conceal his role as part of a military network spying on Nixon and his national security adviser, Henry Kissinger (see December 1971). Haig orchestrated the titular “silent coup” to engineer Nixon’s removal from office.
Haig was the notorious “Deep Throat,” the inside source for Washington Post reporter Bob Woodward (see May 31, 2005). Far from being a crusading young reporter, Woodward is, the book alleges, a “sleazy journalist” trying to cover up his background in military intelligence. Woodward had a strong, if covert, working relationship with Haig. (Weinberg 11/1991; Dean 2006, pp. xv-xvii)
During the phone call, Wallace tells Dean, “According to Silent Coup, you, sir, John Dean, are the real mastermind of the Watergate break-ins, and you ordered these break-ins because you were apparently seeking sexual dirt on the Democrats, which you learned about from your then girlfriend, now wife, Maureen.” Wallace says that the book alleges that Dean had a secretive relationship with E. Howard Hunt, one of the planners of the Watergate burglary. Dean replies that he had little contact with Hunt during their White House careers, and calls the entire set of allegations “pure bullsh_t.” He continues: “Mike, I’m astounded. This sounds like a sick joke.” Wallace says that the authors and publisher, St. Martin’s Press, claim Dean was interviewed for the book, but Dean says no one has approached him about anything related to this book until this phone call. Dean says he is willing to refute the book’s claims on Wallace’s 60 Minutes, but wants to read it first. CBS cannot give Dean a copy of the book due to a confidentiality agreement. (Dean 2006, pp. xv-xvii) Dean will succeed in convincing Time’s publishers not to risk a lawsuit by excerpting the book (see May 7, 1991), and will learn that the book was co-authored behind the scenes by Watergate burglar and conservative gadfly G. Gordon Liddy (see May 9, 1991 and After). The book will be published weeks later, where it will briefly make the New York Times bestseller list (see May 1991) and garner largely negative reviews (see June 1991).
Former White House counsel John Dean tells Time reporter Hays Gorey that he plans on suing the authors and the publishers of the book Silent Coup, which alleges that Dean planned the Watergate burglary (see 2:30 a.m.June 17, 1972) to prove that Democrats were operating a prostitution ring, and that Dean’s wife Maureen had inside knowledge of the prostitution ring (see May 6, 1991). Dean’s position is simple: the book is a farrago of lies and misinformation, and the accusations are libelous (see May 6, 1991). Dean also speaks with Time publisher Henry Muller, and Muller agrees to halt his magazine’s planned publication of an excerpt from the book. Gorey is amazed: Time has already paid $50,000 for the rights to publish portions of the book. “You did it,” Gorey tells Dean. “Muller pulled the story. The whole thing. We’re not going to even mention Silent Coup. I have only seen that happen once before in my thirty years with Time.” Dean later writes, “[Gorey] was ebullient, clearly proud that Time had done the right thing.” The book’s publisher, St. Martin’s Press, refuses to suspend publication. (Dean 2006, pp. xviii-xix)
The authors of the upcoming book Silent Coup, Leonard Colodny and Robert Gettlin, are interviewed on CBS’s Good Morning America. The book alleges that former White House counsel John Dean masterminded the Watergate burglary (see 2:30 a.m.June 17, 1972) to prove that Democrats were operating a prostitution ring, and that Dean’s wife Maureen had inside knowledge of the prostitution ring (see May 6, 1991). Dean has already convinced CBS’s flagship news program, 60 Minutes, not to air a segment on the book, and convinced Time magazine not to excerpt the book in its upcoming issue (see May 7, 1991). Dean says the book is false to the point of libel (see May 6, 1991). Dean has informed the Good Morning America producers of his intention to sue both the authors and the publisher of the book. Reflecting on the affair in his 2006 book Conservatives Without Conscience, Dean writes: “[W]e had mortally wounded the book and destroyed the carefully planned launch, which might had given the story credibility. Now it would be difficult to treat Silent Coup as legitimate news.” Dean recalls being less than impressed with the authors as they discuss their book with Good Morning America’s anchor, Charles Gibson. Colodny, whom Dean will describe as “a retired liquor salesman and conspiracy buff,” and Gettlin, “a journalist,” appear “tense.” Gibson does not believe their story, Dean observes. Gibson skims past the material concerning Dean and his wife, and focuses on the equally specious allegations about Washington Post reporter Bob Woodward (supposedly a CIA agent) and then-White House chief of staff Alexander Haig (who supposedly planned the “coup” of the title that forced Richard Nixon out of office). Silent Coup authors Leonard Colodny and Robert Gettlin (see May 6, 1991 and May 6, 1991) appear on CNN’s Larry King Live. Defending themselves from charges by former White House counsel John Dean that they have libeled him and his wife Maureen (see May 7, 1991), the authors deny any allegations against Maureen Dean even though their book claims that she is the key to understanding the entire Watergate conspiracy. Halfway through the show, Dean will write, the authors “disappear… without explanation, as if snatched from their seats by hooks.” They are replaced by Washington Post reporter Howard Kurtz and convicted Watergate burglar G. Gordon Liddy. Liddy falsely claims that John Dean and others named in the book, particularly Post reporter Bob Woodward and former White House chief of staff Alexander Haig, refused to appear on 60 Minutes to refute the charges by Colodny and Gettlin. Liddy also lies about Time magazine’s decision not to excerpt the book, saying that the book is “so densely packed that it did not lend itself to being excerpted, and they felt that they couldn’t do it.” In reality, Dean, Woodward, and Haig had all agreed to appear on 60 Minutes to refute the book; CBS pulled the segment because the authors could not prove any of their sensational claims about prostitution rings and CIA manipulations. Time chose not to print the excerpt after Dean alerted them that he was filing lawsuits against the authors and the publisher, St. Martin’s Press. 60 Minutes reporter Mike Wallace, who would have anchored the segment, calls King to refute Liddy’s misrepresentations. Wallace says: “We objected to the fact that the authors refused or declined to let the objects of their scrutiny, these three in particular, see the book, read the book ahead of time, so that they could face the charges.… We could not, on our own, source the thing sufficiently to satisfy ourselves that it stood up as a 60 Minutes piece. That’s why we didn’t do the piece.” Watching the interview, Maureen Dean applauds as Wallace destroys the book’s credibility on the air. (Dean 2006, pp. xx-xxi)
