In a report to President Eisenhower, the Joint Chiefs of Staff make the following observation: “We should do what is necessary even if the result is to change the American way of life. We could lick the whole world if we are willing to adopt the system of Adolf Hitler.” [Hunt, 9/1/2009, pp. 5]
A few days before his inauguration, President-elect Jimmy Carter says to the assembled Joint Chiefs of Staff that he can envision the US and the Soviet Union having much smaller nuclear arsenals—perhaps as low as 200 submarine-based nuclear missiles each, in essence a purely deterrent force. When the comment is leaked to conservative columnists Rowland Evans and Robert Novak, the two write in their column that the chairman of the Joint Chiefs, General George Brown, was “[s]tunned speechless” by the remark. In his inaugural address, Carter continues the theme of nuclear disarmament between the two superpowers, saying he intends to try to “limit the world’s armaments to those necessary for each nation’s domestic safety.” As for the world’s nuclear arsenals, he says, “[W]e will move this year a step towards the ultimate goal—the elimination of all nuclear weapons from this Earth.” [Scoblic, 2008, pp. 105]
Reagan officials reopen the stalled Intermediate-Range Nuclear Forces (INF) arms limitation talks with the Soviet Union, against the advice of President Reagan’s more hardline officials (see January 1981 and After). The talks center on the Soviets’ SS-20 missile, designed to strike European targets. In return, then-President Carter had agreed to deploy US intermediate-range nuclear missiles—Pershing II’s and Tomahawks—in West Germany and Italy by 1983. According to author J. Peter Scoblic, the missiles have little real military value, as American ICBMs, submarine-based nuclear missiles, and long-range bombers could destroy Soviet targets with near-impunity. They do, however, have some political significance, mostly in helping tie European security to US security. Carter had agreed to open talks with the Soviets to get rid of the SS-20s entirely.
Hardliners Sabotage Talks - The more pragmatic Reagan officials succeed in reopening the talks; Reagan hardliners, thwarted in stopping the talks, set about sabotaging them in any way available. When arguments in favor of delays and “further study” finally fail, they pressure Reagan to offer an agreement they know the Soviets will refuse: the so-called “zero option,” which originates with Defense Department official Richard Perle (see Early 1981 and After). Perle says that the Soviets should remove all of the SS-20s, and in return, the US will not deploy its Pershings and Tomahawks—in essence, having the Soviets concede something for essentially nothing. State Department officials suggest a fallback position in case the Soviets reject Perle’s offering; in his turn, Perle appears before the Senate Armed Services Committee and compares anyone who opposes his zero-sum offering to Neville Chamberlain’s appeasement of Adolf Hitler in 1938.
'Walk in the Woods' - When the Soviets reject Perle’s option, Reagan hardliners argue that the government should accept no compromise. The head of the INF negotiation team, Paul Nitze—a Cold War figure who has come out against arms control (see January 1976) but is not fully trusted by the hardline ideologues because of his history as an arms negotiator—wants a compromise. In official negotiations, he sticks to the all-or-nothing position of Perle, but opens private, informal negotiations with his Soviet counterpart, Yuli Kvitsinsky. One afternoon in 1982, Nitze and Kvitsinsky go for what later becomes known as their “walk in the woods.” Sitting together on a log during an afternoon rainstorm, the two hammer out an agreement that greatly favors the US—mandating a 67 percent reduction in Soviet SS-20s and allowing the US to deploy an equal number of Tomahawks. Not only would the Soviets have to reduce their already-deployed contingent of missiles and the US be allowed to deploy missiles, because the Tomahawks carry more independent warheads than the SS-20s, the US would have a significant advantage in firepower. The deal also sets limits on SS-20 deployments in Asia, and forbids the Soviets from developing ground-launched cruise missiles. In return, the US would agree not to deploy its Pershing missiles.
Hardliners Block Agreement - Perle and his hardline allies in the Reagan administration succeed in blocking acceptance of the Nitze-Kvitsinsky agreement. As author J. Peter Scoblic later writes, “Perle’s ideological obstructionism—concisely conveyed in his disparagement of Nitze as ‘an inverterate problem-solver’—reached fantastic heights.” Perle first tried to block Reagan from even learning the details of the agreement, and lied to Reagan, asserting falsely that the Joint Chiefs of Staff opposed the agreement. Perle, in conjunction with Defense Secretary Caspar Weinberger, eventually convinces Reagan to stick to the “zero option.” Perle argues against pressure from key US allies such as Britain’s Margaret Thatcher, telling Reagan, “We can’t just do something; we’ve got to stand there—and stand firm.” In 1983, Perle tells Weinberger that it would be better for the US to deploy no missiles at all than to accept the agreement. Scoblic will write: “In other words, he argued that foregoing deployment in return for nothing was better than foregoing deployment in exchange for something. The position made no sense, but the Reagan team held firm to it, once again preventing the adoption of a viable arms control deal.” When the US deploys Pershing missiles in Europe in November 1983, the Soviets walk out of the talks. Air Force General David Jones, chairman of the Joint Chiefs of Staff, says that the idea of winning a protracted nuclear war, as espoused by the Pentagon (see March 1982), is not tenable. “I don’t see much of a chance of nuclear war being limited or protracted,” he says. “I see great difficulty in keeping any kind of exchange between the US and the Soviets from escalating.” He adds: “If you try to do everything to fight a protracted nuclear war, then you end up with the potential of a bottomless pit.… We can’t do everything. I personally would not spend a lot of money on a protracted nuclear war.” [Air Force Magazine, 3/2008]
National Security Council officials, led by NSC Director Robert McFarlane, Deputy Director John Poindexter, and senior NSC official Oliver North, develop a two-part strategy to topple the regime of Libyan dictator Mu’ammar al-Qadhafi. The plan is dubbed “Operation Flower,” with its two components called “Operation Tulip” and “Operation Rose,” respectively. Operation Tulip would be a covert CIA strategy using Libyan exiles to move into Tripoli and overthrow al-Qadhafi in a coup d’etat. Operation Rose proposes a joint US-Egyptian military campaign against the Libyan government. Defense Secretary Caspar Weinberger considers the entire idea “ludicrous,” as do his deputy Richard Armitage and the Joint Chiefs of Staff. However, CIA Director William Casey orders his deputy, Robert Gates, to study the idea. When the CIA produces Gates’s report favoring the idea, the Pentagon develops a military plan deliberately designed to scuttle the idea. The proposed US-Egyptian deployment, the Pentagon strategy says, would require six divisions and 90,000 US troops. Gates says the strategy looks “a lot like the [World War II] invasion of Normandy.” He registers his opposition to such a huge operation, warning that many American citizens as well as US allies would oppose any such overt military campaign. State Department officials concur with Gates’s analysis, and the US ambassador to Egypt, Nick Veliotes, says he believes Egyptian President Hosni Mubarak would want nothing to do with the idea, in part because Mubarak has little confidence in the US military’s willingness to fight for an extended period of time, and so it would leave Egyptian forces to fight alone. Although Poindexter and other NSC officials continue to push the plan, even proposing it to an unimpressed Mubarak, no one else in the Reagan administration supports it, and it is never implemented. CIA Director William Casey introduces a plan to break the stalled arms-for-hostages deal with Iran that has been moribund for over a month (see Late May, 1986). Like his boss President Ronald Reagan, Casey has a powerful Cold War mentality and a love of covert operations; like Reagan, Casey believes that building relations with Iran is a way to counter Soviet expansionism. Casey’s plan appears on the agenda of a meeting of the Contingency Pre-Planning Group (CPPG), an inter-agency committee consisting of mid-level representatives of the National Security Council, the Departments of State and Defense, the Joint Chiefs of Staff, and the CIA. The meeting focuses on Iraq’s failures in its long, dismal war against Iran. Casey believes that if Iraq escalates its air attacks on Iran, Iran will need more and more arms from the US, and that will force it to conclude the stalled arms-for-hostages deal on favorable terms. And Casey, ever the espionage aficionado, is playing the two opposing factions—one pro-Iran, one pro-Iraq—within the administration (see January 14, 1984) against one another, according to two CIA aides who work closely with him. Those aides, who speak to reporters in 1992 after leaving the agency, will say he even keeps some White House officials ignorant of the “double nature of his plan.” In furthering his own murky strategies, Casey is also enlisting the support of State and Defense Department officials who fear an imminent Iranian victory. Casey believes that the war will continue as a stalemate for several years, but he deliberately slants his intelligence assessments to paint a graver picture of Iraq’s imminent defeat (Iraq’s fortunes in the war are grim enough to require little embellishment).
CPPG Unable To Find Solutions for Iraq - The CPPG is tasked with shoring up the US’s commercial and financial relationships with Iraq, a chore for which the group cannot find an immediate solution. The CPPG has also considered using Jordan as a conduit for arms to Iraq, similar to the way Israel has served as a conduit for US arms to Iran (see 1981), but the group rejects that idea because, according to a memo from the meeting, “any such transfer has to be notified to the Congress and thus made public.”
Iraq's Antiquated War Strategies - The group finally discusses a matter that plays into Casey’s plan, Iraq’s failure to fight the war in a modern fashion. Iraq uses its powerful air force extremely poorly, at times seemingly afraid to commit planes on missions that might put a single aircraft at risk. Former ambassador Richard Murphy will say of Iraq, “The Iraqis were fighting the way Germans might have in the First World War. They were good at holding a defense line, which is useful in holding back the human waves of Iranians. But when it came to their air force they were inept. On bombing missions, in particular, the Iraqis were so afraid to lose planes that they often didn’t undertake missions, and when they did they did only things that were safe.” Reagan has already issued secret authorizations for Saudi Arabia to transfer US-origin bombs to Iraq, to induce it to use its air force more effectively (see February 1986), to little avail. Now the CPPG says that Vice President George Bush might help out; Bush is making a trip to the Middle East as Reagan’s “peace envoy” (see July 23, 1986). The CPPG decides that Bush might suggest to Jordan’s King Hussein and Egypt’s President Mubarak that the two “sustain their efforts to convey our shared views to Saddam regarding Iraq’s use of its air resources.” The CPPG is not sanguine about the likelihood of Bush’s success, considering the distrust Saddam Hussein maintains for the US. The CPPG recommends that the White House send “a senior US emissary” to confer directly with Hussein; the CPPG is apparently unaware that Casey has already spoken privately with Bush and asked him to meet in secret with Hussein (see July 23, 1986). Paul Wolfowitz, the neoconservative undersecretary of policy for Defense Secretary Dick Cheney, promotes the export of advanced AIM-9M air-to-air missiles to Israel. This is discovered by a lengthy investigation by the Bush administration into the export of classified weapons technology to China. The Joint Chiefs of Staff, aware that Israel has already been caught selling an earlier version of the AIM missile to China in violation of a written agreement between Israel and the US, intervenes to stop the missile sales. Wolfowitz retains his position at the Defense Department until he and most of his neoconservative colleagues are turned out of the federal government by the onset of the Clinton administration. A joint US-British air force strike team bombs 20 radar and command centers inside Iraq, enforcing the UN no-fly zones in the largest air strikes within Iraq in two years. While the White House is informed of the strikes by a general from the Joint Chiefs of Staff (JCS), Defense Secretary Donald Rumsfeld is livid because he feels he hasn’t been given enough information about the strikes quickly enough. Rumsfeld’s information comes to him, by established law and protocol, through the chairman of the Joint Chiefs of Staff, General Henry Shelton; thus it could be hours before Rumsfeld learns of such events. Saying, “I’m the secretary of defense. I’m in the chain of command,” Rumsfeld decides to upend the entire system and ensure that he, not Shelton, will be informed first about any such operations. Rumsfeld presses Shelton for information about the reporting of the air strikes: who had selected those targets and why, who had briefed, who had been briefed, and most importantly, why wasn’t Rumsfeld consulted? CNN had reported air strikes in Baghdad, though the actual bases struck were not in the city itself; it looked for a moment if the US had just declared unilateral war on Iraq. Rumsfeld feels misled and ignored. He is the one in the chain of command, he insists, he is the one reporting to the president, so he should be informed first. Shelton replies that he has to know what’s going on, to know what details to press for and what questions to ask, in order to properly inform the Secretary of Defense, who can then properly inform the president. Rumsfeld insists on being informed before Shelton, and demands a top-to-bottom review of the procedures involving the National Military Command Center (NMCC) and detailed timelines of each incident where Shelton was informed before Rumsfeld. Secretary of Defense Donald Rumsfeld sends members of the Joint Chiefs of Staff a copy of the foreword to a book, which discusses the US government failures that led to the Japanese attack on Pearl Harbor, Hawaii, in 1941. Rumsfeld sends a memo to the chairman, vice chairman, and the other members of the Joint Chiefs of Staff, in which he refers to a discussion about intelligence that was held on the previous day. He attaches to it a copy of the foreword to Roberta Wohlstetter’s 1962 book, Pearl Harbor: Warning and Decision, written by the Harvard economist Thomas Schelling. He writes in the memo, “I think you will find [Schelling’s foreword] worth reading.” [Donald Rumsfeld, 3/14/2001 ; New York Times, 3/27/2014] In the foreword, Schelling wrote that in order to prepare for the next crisis, the US military needs to avoid thinking that the most familiar threat is also the most likely one. [Associated Press, 5/24/2001] Rumsfeld will write in his 2011 memoir that he considers Schelling’s message to be, “We needed to prepare for the likelihood that we would be attacked by an unanticipated foe in ways that we may not imagine.” [Rumsfeld, 2011, pp. xv] Rumsfeld “routinely handed out or recommended” Wohlstetter’s book about the attack on Pearl Harbor in the eight months before 9/11 and “particularly recommended the foreword, written by Thomas Schelling,” according to journalist and author Bob Woodward. [Woodward, 2002, pp. 22] He will give copies of Schelling’s foreword to members of the House Armed Services Committee when he meets with them on May 23 (see May 23-24, 2001). [Source: Effingham Daily News]The Joint Chiefs of Staff (JCS) activates its Crisis Action Team (CAT) at the Pentagon to respond to the terrorist attacks, although the time this occurs at is unclear. [US Congress, 9/13/2001; 9/11 Commission, 7/21/2003 ; US Air Force, 9/9/2003] General Richard Myers, the vice chairman of the JCS, will later tell a congressional hearing that in response to the attacks on the World Trade Center: “We stood up our Crisis Action Team.… And we started talking to the federal agencies.” [US Congress, 9/13/2001] The JCS’s CAT apparently assembles in the National Military Command Center (NMCC), which is located in the JCS area of the Pentagon and is responsible for monitoring worldwide events for the JCS. [9/11 Commission, 7/21/2003 ; GlobalSecurity (.org), 7/24/2011; Effingham Daily News, 9/12/2011] Myers will state that the CAT is activated just after 8:46 a.m., when the first hijacked plane crashed into the WTC (see 8:46 a.m. September 11, 2001). He will say it is activated “[a]t the time of the first impact on the World Trade Center.” “That was done immediately,” he will add. [US Congress, 9/13/2001] However, other accounts will indicate that the CAT is activated after 9:37 a.m., when the Pentagon attack occurs (see 9:37 a.m. September 11, 2001). Lieutenant Colonel Lyndon Willms is an Air Force officer currently assigned to the Pentagon, working as a joint strategic planner for the JCS. After he and his colleagues in the Joint Vision and Transformation Division of the JCS learn from television reports of the second hijacked plane hitting the WTC, at 9:03 a.m. (see 9:03 a.m. September 11, 2001), they “knew a decision would be made to either send us to augment one of the crisis action teams forming in the National Military Command Center across the hall or be evacuated to another site,” Willms will recall. It appears from Willms’s account, however, that the CAT is only activated later on. By around 9:51 a.m., Willms will state, the CAT is forming in the NMCC, but he and his colleagues are “a bit confused because we thought we would be going in to augment” it. Instead, they are evacuated from the Pentagon. [Effingham Daily News, 9/12/2011] Lieutenant Colonel James Foley, the NMCC operations officer, will also indicate that the CAT is only activated after the Pentagon is hit. He will state that “a Joint Staff Crisis Action Team assembled… within the first two hours, while the situation was entirely uncertain and the Pentagon was burning.” [US Air Force, 9/9/2003] And when they visit the NMCC in 2003, members of the 9/11 Commission staff will be told that a CAT “was stood up” in the NMCC “sometime in the afternoon on 9/11.” [9/11 Commission, 7/21/2003 ] It is apparently standard procedure for the JCS to activate its CAT during a terrorist attack. A Department of Defense memorandum sent in March 2001, about how the US military responds to terrorism, will state that in a crisis, the operations directorate of the JCS “establishes a Crisis Action Team (CAT) to prepare and coordinate deployment, and execute orders.” [US Department of Defense, 3/15/2001]
When Flight 77 hits the Pentagon, it misses the parts of the building known to house the military’s most senior leaders. Journalist and author Steve Vogel later says, “The hijackers had not hit the River or Mall sides” of the building, “where the senior military leadership had been concentrated since 1942.” At the time of the attack, Secretary of Defense Donald Rumsfeld is “sitting in the same third-floor office above the River entrance as every secretary of defense since Louis Johnson in 1949, a location that had been a matter of public record all that time. The joint chiefs and all the service secretaries were arrayed in various prime E-Ring offices on the River and Mall sides.” Furthermore, “All the command centers save the Navy’s were on the River or Mall sides; the National Military Command Center could have been decimated as the Navy Command Center was, a disaster that could have effectively shut down the Pentagon as the first American war of the twenty-first century began.” Instead, the area hit comprises Army accounting offices, the Navy Command Center, and the Defense Intelligence Agency’s comptroller’s office. [Vogel, 2007, pp. 431 and 449-450] Due to recent renovation work, many offices in that section of the Pentagon are currently empty. [Government Executive, 9/11/2001]
The US Congress adopts a joint resolution, the Authorization for Use of Military Force (AUMF), that determines that “the president is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.” Congress also states that the “grave acts of violence” committed on the US “continue to pose an unusual and extraordinary threat to [its] national security and foreign policy.” [US Congress, 9/14/2001] President Bush signs the resolution into law on September 18. [White House, 9/18/2001] The passage of the AUMF served another purpose: to extend presidential power. While the Defense Department and the Joint Chiefs of Staff intended the AUMF to define the conflict in narrow terms, and authorize the US to move militarily against al-Qaeda and its confederates, and the Taliban, Vice President Dick Cheney and his chief of staff, David Addington, had a larger goal. Attorney Scott Horton, who has written two major studies on interrogation of terrorism suspects for the New York City Bar Association, says in 2005 that Cheney and Addington “really wanted [the AUMF defined more broadly], because it provided the trigger for this radical redefinition of presidential power.” Addington helped draft a Justice Department opinion in late 2001, written by lawyer John Yoo (see Late September 2001), that asserted Congress cannot “place any limits on the president’s determinations as to any terrorist threat, the amount of military force to be used in response, or the method, timing, and nature of the response.” [US News and World Report, 5/21/2006]

The CIA sends a one-and-a-half-page cable to the White House, the FBI, the Justice Department, the Joint Chiefs of Staff, and the Defense Intelligence Agency, with news that a CIA source sent to Niger has failed to find any evidence to back claims that Iraq sought uranium from that country (see February 21, 2002-March 4, 2002). The cable contains an initial report of the source’s findings in Niger. Caveats and Denials - The report does not name the CIA source or indicate that the person is a former ambassador. Instead it describes the source as “a contact with excellent access who does not have an established reporting record” and notes that the Nigeriens with whom he spoke “knew their remarks could reach the US government and may have intended to influence as well as inform.” A later Senate report on the US’s pre-war intelligence on Iraq will state: “The intelligence report indicated that former Nigerien Prime Minister Ibrahim Mayaki was unaware of any contracts that had been signed between Niger and any rogue states for the sale of yellowcake while he was prime minister (1997-1999) or foreign minister (1996-1997). Mayaki said that if there had been any such contract during his tenure, he would have been aware of it.” Mayaki, according to the report, also acknowledged a June 1999 visit (see June 1999) by a businessman who arranged a meeting between Mayaki and an Iraqi delegation to discuss “expanding commercial relations” between Niger and Iraq. The intelligence report says that Mayaki interpreted “expanding commercial relations” to mean that the delegation wanted to discuss purchasing uranium. The meeting did take place, but according to the report, “Mayaki let the matter drop due to UN sanctions on Iraq.” The intelligence report also says that Niger’s former Minister for Energy and Mines, Mai Manga, told Wilson that there have been no sales outside of International Atomic Energy Agency (IAEA) channels since the mid-1980s. Mai Manga is also reported to have described how the French mining consortium controls Nigerien uranium mining and keeps the uranium very tightly controlled from the time it is mined until the time it is loaded onto ships in Benin for transportation overseas. Manga said he believed it would be difficult, if not impossible, to arrange a special clandestine shipment of uranium to a country like Iraq. [US Congress, 7/7/2004]
White House: Report Left Out Details, Considered Unimportant - Bush administration officials will say in June 2003 that the report left out important details, such as the trip’s conclusions. And consequently, the Washington Post will report in June 2003, “It was not considered unusual or very important and not passed on to Condoleezza Rice, the president’s national security adviser, or other senior White House officials.” [Washington Post, 6/12/2003 ; Washington Post, 6/13/2003; Knight Ridder, 6/13/2003]
CIA Source Doubts White House Claims - But the CIA source who made the journey, former ambassador Joseph Wilson, will find this explanation hard to believe. “Though I did not file a written report [he provided an oral briefing (see March 4-5, 2002)], there should be at least four documents in United States government archives confirming my mission,” he will later explain. “The documents should include the ambassador’s report of my debriefing in Niamey, a separate report written by the embassy staff, a CIA report summing up my trip, and a specific answer from the agency to the office of the vice president (this may have been delivered orally). While I have not seen any of these reports, I have spent enough time in government to know that this is standard operating procedure.” [New York Times, 7/6/2003]
Senior CIA Case Officer Backs Up Source - In 2007, Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will write of the report (see March 4-5, 2002) that if standard protocol has been followed, the report is distributed to “all the government departments that have intelligence components, such as the State Department’s Bureau of Intelligence and Research (INR), the National Security Agency (NSA), the Pentagon, and the overseas military commands. All of us had every reason to believe that their finished report would indeed be sent to the vice president’s office as part of the established protocol.” According to Plame Wilson, who read the report when it was completed (see (March 6, 2002)), much of the report focuses on “Niger’s strict, private, and government controls on mining consortia to ensure that no yellowcake went missing between the uranium mines and the marketplace.” She will write in 2007 that her husband’s report “corroborated and reinforced what was already known.” Both she and her husband assume that the allegations are sufficiently disproven and will not be heard of again. [Wilson, 2007, pp. 112-114]
Little New Information - According to intelligence analysts later interviewed by Congressional investigators, the intelligence community does not believe the trip has contributed any significant information to what is already known about the issue, aside from the details of the 1999 Iraqi delegation. After the existence of the Defense Department’s new Nuclear Posture Review (NPR) (see December 31, 2001) is leaked to the media, the chairman of the Joint Chiefs of Staff, Richard Myers, goes on CNN to claim that the document has little real meaning in an operational sense, but instead is just a policy document that outlines the general US deterrence strategies towards nations with weapons of mass destruction. Nuclear weapons are just one part of that strategy, Myers says. Myers says that the document merely preserves the president’s options “in case this country or our friends and allies were attacked with weapons of mass destruction, be they nuclear, biological, chemical, or for that matter high explosives.” He adds: “It’s been the policy of this country for a long time that the president would always reserve the right up to and including the use of nuclear weapons if that was appropriate. So that continues to be the policy.” [CNN, 3/10/2002] Myers’ attempts to downplay the NPR are inaccurate, as it is a new operational policy that plans for pre-emptive nuclear strikes against countries attempting to create weapons of mass destruction, if the White House deems such strikes necessary. Dismayed at the lack of post-invasion planning in the Defense Department (see August 2002), the Joint Chiefs of Staff advance their own proposal for a military command to govern Iraq after the overthrow of Saddam Hussein. Defense Secretary Donald Rumsfeld insists on a split between military and civilian functions; he places Undersecretary for Policy Douglas Feith in charge of planning for the civilian administration. Feith, whom CENTCOM commander Tommy Franks calls “the dumbest f_cking guy on the planet,” is an academic with no experience at administration on such a level, and will be roundly excoriated for his incompetence in handling the assignment. Author and public administration professor Alasdair Roberts will later write that beyond Feith’s lack of competence is a bureaucratic failure: the Pentagon “was simply reaching beyond its abilities.” A RAND report will later find the Defense Department “lacked experience, expertise, funding authority, local knowledge, and established contacts with other potential civilian organizations” to do the task it had set for itself. Roberts will write that the Pentagon will substitute improvisation for meticulous planning (see January 2003). [Roberts, 2008, pp. 126, 134]
The Bush White House establishes a “high-level, interagency task force” charged with the task of “coordinating all Iraq war planning efforts and postwar initiatives.” The task force is headed by the Deputies Committee, which is made up of the “No. 2 officials at the Pentagon, Joint Chiefs of Staff, State Department, CIA, National Security Council, and vice president’s office.” The committee’s job is to review the work of other groups who have been involved in the planning of post-war Iraq, and provide recommendations to President Bush’s top advisers. The committee draws on the work of the Pentagon’s Office of Special Plans (OSP) (see 2002-2003 and September 2002), Elliott Abrams’s group (see November 2002-December 2002 and December 2002) and the State Department’s “Future of Iraq” project (see April 2002-March 2003). Later accounts make clear that Abrams’s and the OSP’s recommendations have much more influence. The Deputies Committee usually meets in the White House situation room. National Security Adviser Condoleezza Rice keeps Bush updated on the progress of the task force’s work. In November, US News and World Report reports that a consensus is forming “at the highest levels of the Bush administration over how to run the country after Saddam and his regime are history.” [Financial Times, 11/4/2002; US News and World Report, 11/25/2003; Reuters, 11/25/2003]

No US-Created Government - The US should not create a provisional government or a government in exile. “We are not going to be in the business of choosing” who should lead Iraq, a senior official tells US News and World Report. [US News and World Report, 11/25/2003]
Lengthy Occupation - The invasion of Iraq will likely be followed by a lengthy occupation. This conclusion is passed on to Bush. “I have been with the president when he has been briefed about the need to have US forces there for an extended period of time,” a senior administration official will later tell US News and World Report. [US News and World Report, 11/25/2003]
Military Occupation Rule before Turning over Rule to Iraqis - During the first phase of the occupation, Iraq will be ruled by the military, probably a US general. The primary objective during this phase will be maintaining security and preventing the emergence of hostilities between the Shi’ites and Sunnis. Pentagon officials involved in planning this stage are reported to have reviewed the archived plans for the occupation of Germany and Japan. The second phase of the occupation will involve some sort of international civilian administration, with a diminished US military presence, and Iraqis will be given a larger role in the government. In the last phase, a constitution will be drafted, transferring power to a representative, multiethnic Iraqi government that commits to being free of weapons of mass destruction. War Paid for by Iraqi Oil - Revenue generated from the sale of Iraq’s oil will be used for the cost of reconstruction and for conducting humanitarian operations. Hardliners however want the funds to pay for the military costs of the invasion as well. [US News and World Report, 11/25/2003]
Dissension over Roles of Iraqi Exiles - No firm decisions are made about the what role, if any, Iraqi exiles affiliated with the Iraqi National Congress (INC) will play in post-Saddam Iraq. Pentagon hardliners and some top officials in the White House favor giving them a prominent role, while the CIA and State Department adamantly oppose their inclusion, arguing that the exiles cannot be trusted. Lieutenant Colonel Diane Beaver, the top legal adviser to the Army’s interrogation unit at Guantanamo, JTF-170, writes a legal analysis of the extreme interrogation techniques being used on detainees. Beaver notes that some of the more savage “counter-resistance” techniques being considered for use, such as waterboarding (the use of which has resulted in courts-martials for users in the past) might present legal problems. She acknowledges that US military personnel at Guantanamo are bound by the Uniform Code of Military Justice, which characterizes “cruelty,” “maltreatment,” “threats,” and “assaults” as felonies. However, she reasons, if interrogators can obtain “permission,” or perhaps “immunity,” from higher authorities “in advance,” they might not be legally culpable. In 2006, a senior Defense Department official calls Beaver’s legal arguments “inventive,” saying: “Normally, you grant immunity after the fact, to someone who has already committed a crime, in exchange for an order to get that person to testify. I don’t know whether we’ve ever faced the question of immunity in advance before.” The official praises Beaver “for trying to think outside the box. I would credit Diane as raising that as a way to think about it.” Beaver will later be promoted to the staff of the Pentagon’s Office of General Counsel, where she will specialize in detainee issues. But Naval General Counsel Alberto Mora is less impressed. When he reads Beaver’s legal analysis two months later (see December 17-18, 2002), he calls it “a wholly inadequate analysis of the law.” According to Mora, the Beaver memo held that “cruel, inhuman, or degrading treatment could be inflicted on the Guantanamo detainees with near impunity.” Such acts are blatantly illegal, Mora believes. Mora will note that Defense Secretary Donald Rumsfeld bases his decision to approve such harsh “counter-resistance” techniques (see December 2, 2002) in part on Beaver’s memo. He will write that Rumsfeld’s decision “was fatally grounded on these serious failures of legal analysis.” Neither Beaver nor Rumsfeld will draw any “bright line” prohibiting the combination of these techniques, or defining any limits for their use. As such, this vagueness of language “could produce effects reaching the level of torture,” which is prohibited without exception both in the US and under international law. [New Yorker, 2/27/2006]
Written under Difficult Circumstances - Beaver later tells a more complete story of her creation of the memo. She insists on a paper trail showing that the authorization of extreme interrogation techniques came from above, not from “the dirt on the ground,” as she describes herself. The Guantanamo commander, Major General Michael Dunlavey, only gives her four days to whip up a legal analysis, which she sees as a starting point for a legal review of the interrogation policies. She has few books and materials, and more experienced lawyers at the US Southern Command, the Judge Advocate General School, the Joint Chiefs of Staff, and the DIA refuse to help her write the analysis. She is forced to write her analysis based on her own knowledge of the law and what she could find on the Internet. She bases her analysis on the previous presidential decision to ignore the Geneva Conventions, later recalling, “It was not my job to second-guess the president.” Knowing little of international law, she ignores that body of law altogether. She fully expects her analysis to be dissected and portions of it overridden, but she is later astonished that her analysis will be used as a legal underpinning for the administration’s policies. She has no idea that her analysis is to be used to provide legal cover for much more senior White House officials (see June 22, 2004). She goes through each of the 18 approved interrogation techniques (see December 2, 2002), assessing them against the standards set by US law, including the Eighth Amendment, which proscribes “cruel and unusual punishment,” the federal torture statutes, and the Uniform Code of Military Justice. Beaver finds that each of the 18 techniques are acceptable “so long as the force used could plausibly have been thought necessary in a particular situation to achieve a legitimate government objective, and it was applied in a good faith effort and not maliciously or sadistically for the very purpose of causing harm.” Law professor Phillippe Sands later observes: “That is to say, the techniques are legal if the motivation is pure. National security justifies anything.” The interrogators must be properly trained, Beaver notes, and any interrogations involving the more severe techniques must “undergo a legal, medical, behavioral science, and intelligence review prior to their commencement.” However, if all of the criteria are met, she “agree[s] that the proposed strategies do not violate applicable federal law.” Sands points out that her use of the word “agree” indicates that she “seems to be confirming a policy decision that she knows has already been made.”
'Awful' but Understandable - Sands later calls her reasoning “awful,” but understands that she was forced to write the memo, and reasonably expected to have more senior legal officials review and rewrite her work. “She could not have anticipated that there would be no other piece of written legal advice bearing on the Guantanamo interrogations. She could not have anticipated that she would be made the scapegoat.” Beaver will recall passing Vice President Cheney’s chief of staff David Addington in a Pentagon hallway shortly after she submitted the memo. Addington smiled at her and said, “Great minds think alike.” [Vanity Fair, 5/2008]

Shortly after the October 11, 2002, request by Guantanamo commander Major General Michael Dunlavey for approval of new, harsh interrogation techniques, and after Guantanamo legal counsel Diane Beaver submitted her analysis justifying the use of those techniques (see October 11, 2002), General James T. “Tom” Hill forwards everything to General Richard Myers, the chairman of the Joint Chiefs of Staff. Hill includes a letter that contains the sentence, “Our respective staffs, the Office of the Secretary of Defense, and Joint Task Force 170 [the Army unit in charge of interrogating Guantanamo detainees] have been trying to identify counter-resistant techniques that we can lawfully employ.” In the letter, Hill is clearly ambivalent about the use of severe interrogation methods. He wants the opinion of senior Pentagon lawyers, and requests that “Department of Justice lawyers review the third category [the most severe] of techniques.” But none of this happens. The Joint Chiefs should have subjected the request to a detailed legal review, including scrutiny by Myers’s own counsel, Jane Dalton, but instead, Pentagon general counsel William J. Haynes short-circuits the approval process. Navy General Counsel Alberto Mora recalls Dalton telling him: “Jim pulled this away. We never had a chance to complete the assessment.” Myers later recalls being troubled that the normal procedures had been circumvented. Looking at the “Haynes Memo,” Myers will point out, “You don’t see my initials on this.” He notes that he “discussed it,” but never signed off on it. “This was not the way this should have come about.” Myers will come to believe that there was “intrigue” going on “that I wasn’t aware of, and Jane wasn’t aware of, that was probably occurring between [William J.] Haynes, White House general counsel [Alberto Gonzales], and Justice.” Instead of going through the proper channels, the memo goes straight to Haynes, who merely signs off with a note that says, “Good to go.” [Vanity Fair, 5/2008]

US military commanders in Afghanistan request clarification and guidance from CENTCOM and the Joint Chiefs of Staff as to what interrogation techniques they can use against detainees in US custody. The commanders describe the techniques currently being employed and recommend that they be approved as official policy for Afghanistan operations. Some of the techniques had been approved by Defense Secretary Donald Rumsfeld for Guantanamo exclusively (see December 2, 2002); others had been rescinded altogether. Those officials ignore the request. After a time, the military commanders in Afghanistan will decide that “silence is consent,” and will adopt the techniques being used as “official policy.” [American Civil Liberties Union, 7/10/2006]
A working group appointed by the Defense Department’s general counsel, William J. Haynes, completes a 100-page-plus classified report justifying the use of torture on national security grounds. The group—headed by Air Force General Counsel Mary Walker and including top civilian and uniformed lawyers from each military branch—consulted representatives of the Justice Department, the Joint Chiefs of Staff, the Defense Intelligence Agency, and other intelligence agencies in drafting the report. It was prepared for Secretary of Defense Donald Rumsfeld and was meant to respond to complaints from commanders working at the Guantanamo Bay base in Cuba who claimed that conventional interrogation tactics were inadequate. The conclusions in the report are similar to those of an August 1, 2002 memo (see August 1, 2002) drafted by the Justice Department’s Office of Legal Counsel (OLC). The OLC is said to have also contributed to this report. [US Department of Defense, 3/6/2003; Wall Street Journal, 6/7/2004; Los Angeles Times, 6/10/2004] The report notes that both Congress and the Justice Department will have difficulty enforcing the law if US military personnel could be shown to be acting as a result of presidential orders. President's Authority During War Gives Power to Order Torture, Supersede Law - One of the main conclusions of the report is that the president’s authority as commander-in-chief permits him during times of war to approve almost any physical or psychological interrogation method—including torture—irrespective of any domestic or international law. The report finds, “[I]n order to respect the President’s inherent constitutional authority to manage a military campaign… [the 1994 law banning torture] must be construed as inapplicable to interrogations undertaken pursuant to his Commander-in-Chief authority.” The draft report clearly states that neither Congress, the courts, nor international law has jurisdiction over the president’s actions when the country is waging war. The report asserts that “without a clear statement otherwise, criminal statutes are not read as infringing on the president’s ultimate authority” to wage war. Furthermore, “any effort by Congress to regulate the interrogation of unlawful combatants would violate the Constitution’s sole vesting of the commander-in-chief authority in the president.” According to the document, the federal Torture Statute simply does not apply. “In order to respect the president’s inherent constitutional authority to manage a military campaign… (the prohibition against torture) must be construed as inapplicable to interrogations undertaken pursuant to his commander-in chief authority,” the report states (The parenthetical comment is in the original document). A career military lawyer will later tell the Wall Street Journal that many lawyers disagreed with these conclusions, but that their concerns were overridden by the political appointees heading the drafting of the report. The lawyer explains that instead, military lawyers focused their efforts on limiting the report’s list of acceptable interrogation methods. [Wall Street Journal, 6/7/2004; Washington Post, 6/8/2004]
Guantanamo Bay Not Covered under Torture Restrictions - The report also finds that the 1994 law barring torture “does not apply to the conduct of US personnel” at Guantanamo Bay, nor does it apply to US military interrogations that occurred outside US “maritime and territorial jurisdiction,” such as in Iraq or Afghanistan. [Washington Post, 6/8/2004]
Legal Arguments to Defend against Torture Charges Conflict with International Statutes - The draft report lists several possible arguments that US civilian or military personnel might use to defend themselves against charges of torture or other war crimes. According to the administration’s lawyers, one argument would be that such actions were “necessary” in order to prevent an attack. However, this rationale seems to ignore very clear statements in the Convention Against Torture (see October 21, 1994) which states that “no exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture.” Another line of defense, the report says, would be to claim that the accused had been acting under “superior orders” and that therefore no “moral choice was in fact possible.” Likewise, the report cites a Justice Department opinion, which the draft report says “concluded that it could not bring a criminal prosecution against a defendant who had acted pursuant to an exercise of the president’s constitutional power.” This also contradicts the Convention against Torture, which states that orders from superiors “may not be invoked as a justification of torture.” The authors of the report also suggest in the draft report that accused officials could argue that they had “mistakenly relied in good faith on the advice of lawyers or experts,” adding, “Good faith may be a complete defense.” The memo also argues that the International Covenant on Political and Civil Rights (ICCPR), to which the US is a party, “does not apply outside the United States or its special maritime and territorial jurisdiction (SMTJ), and that it does not apply to operations of the military during an international armed conflict,” as the US “has maintained consistently.” Since the “Guantanamo Bay Naval Station (GTMO) is included within the definition of the special maritime and territorial jurisdiction of the United States,” the ICCPR does not apply to Guantanamo Bay. The authors are also convinced that officials would not be prosecutable under US law, concluding that “constitutional principles” precluded the possibility that officials could be punished “for aiding the president in exercising his exclusive constitutional authorities” and neither Congress nor the courts had the authority to “require or implement the prosecution of such an individual.” [Wall Street Journal, 6/7/2004]
Defining Parameters of Interrogation Methods - The document attempts to define the parameters of lawful interrogation methods in terms of the degree of pain or psychological manipulation they cause. The report states that the infliction of physical or mental suffering does not constitute torture. To violate Section 2340 A of the US Code, prohibiting physical torture, suffering must be “severe,” the lawyers advise, noting that according to a dictionary definition, this would mean that the pain “must be of such a high level of intensity that… [it] is difficult for the subject to endure.” It must also be “inflicted with specific intent,” they say, meaning that the perpetrator expressly intends to cause severe pain and suffering. But if the defendant simply used pain and suffering as a means to an end, such specific intent would not exist. Under certain circumstances, the lawyers explain, the US would be justified in resorting to illegal measures like torture or homicide. They argue that such measures should be considered “self-defense” in cases where officials “honestly believe” that such actions would prevent an imminent attack against the US. “Sometimes the greater good for society will be accomplished by violating the literal language of the criminal law,” the draft document asserts. “In sum,” the panel determines, “the defense of superior orders will generally be available for US Armed Forces personnel engaged in exceptional interrogations except where the conduct goes so far as to be patently unlawful.” Civil law suits, the panel notes, by a foreign victim of torture will not apply to the US government. Bernard Trainor. [Source: PBS]The New York Times examines the influence of retired military officers in influencing public opinion on the invasion of Iraq. Reporter John Cushman, Jr writes that “a whole constellation of retired one-, two-, three- and four-star generals—including many who led the recent wars in Afghanistan, Kosovo, and the Persian Gulf—can be seen night and day across the television firmament, navigation aids for viewers lost in a narrative that can be foggier than war itself.” All of the news broadcasters, including cable news outlets CNN, MSNBC, and Fox News, and the commercial networks’ news shows on ABC, CBS, and NBC rely on retired military officers to explain to their viewers what is happening in Iraq. Cushman acknowledges the “deep perspective” that the retired officers bring to the war coverage, particularly those who led the same units now on the ground, or at least “commanded, trained, or shared barracks and beers with the current commanders.” Retired Marine General Gregory Newbold recently told an ABC News audience, “If things haven’t gone exactly according to script, they’ve gone according to plan.” Newbold helped draw up the plans for the invasion as director of operations for the Joint Chiefs of Staff.
Questions Raised - How much do the military analysts actually know? Cushman asks, and are they giving out more information than they should? Many of the analysts receive what Cushman calls “occasional briefings from the Pentagon” (he is apparently unaware of the Pentagon’s propaganda operation involving these selfsame analysts—see April 20, 2008 and Early 2002 and Beyond), and garner much of their information from public sources and from their friends and former colleagues in the military. Cushman goes on to observe that almost all of the analysts have “evident sympathies with the current commanders”; between those sympathies and their “immersion in [military] doctrines,” their objectivity is in doubt—or as Cushman delicately phrases it, their experience and bias “sometimes seem to immunize them to the self-imposed skepticism of the news organizations that now employ them.” After conducting “a detailed review of their recent remarks,” Cushman says that it is a rarity when an analyst criticizes the conduct of the war. “Instead, they tend gravely to point out the timeless risks of combat.” One sharp exception is from retired Army General Wesley Clark, the former supreme commander of NATO, who recently questioned whether the military had committed enough troops on the ground. More typical is recent remarks by retired Army General Wayne Downing, a commander in the 1991 Gulf War. Downing lavished praise on the invasion’s supreme commander, General Tommy Franks. Cushman notes that Downing “rattl[ed] off the story of his old comrade’s career as if by rote.”
Technical Details Vs. Analysis - The retired officers do “reasonably well” in explaining what Cushman calls “the nuts and bolts of an operation, the technical details of weapons, the decisions facing American and British commanders.” Their speculations about what the Iraqis might be doing and thinking are more problematic. One analyst, retired Marine General Bernard Trainor, almost seemed to invite chemical or biological retaliation from the Iraqis when he told an MSNBC audience: “If he moves, we kill him; if he stays put, we kill him. And regardless of what they’re told to do over the network, whatever is left of the command and control, unless it comes down to using chemical weapons, then the rest of it is just ancillary. If this is going to be the communication of red telephone, if you will, to tell people to launch chemical weapons—and we’re reaching that point in the operation—if they’re going to use their stuff, they’d better start thinking about it, because pretty soon we’re in downtown Baghdad.” Clark, considered the most polished and urbane of the analysts, takes a different tack, and notes repeatedly that the analysts are careful not to give away details of current operations and thus endanger American troops. All of the analysts, Cushman writes, “emphasize the gravity of what the military is up to in Iraq.” As Clark told an audience, “It’s not entertainment.” [New York Times, 3/25/2003]

McCarthy writes: “Defense Secretary Donald Rumsfeld and the chairman of the Joint Chiefs of Staff have been unhappy with the criticism of their war effort by former military men appearing on television. So am I, but for a different reason. The top people at the Pentagon are wondering why these ex-military talkers can’t follow the company line on how well the war has been fought. I’m wondering why these spokesmen for militarism are on TV in the first place.” McCarthy lists twelve: Lieutenant General Bernard Trainor, Major General Robert Scales, Lieutenant General Gregory Newbold, Major General Donald Shepperd, General Barry McCaffrey, Major General Paul Vallely, Lieutenant General Don Edwards, Lieutenant General Thomas McInerney, Colonel Tony Koren, Lieutenant Colonel Rick Francona, Major Jack Stradley, and Captain Chris Lohman. He asks rhetorically, “Did I miss anyone?” [Washington Post, 4/19/2003] In 2008, after the story of the massive and systematic Pentagon propaganda operation using at least 75 retired military officers to promote the war (see April 20, 2008 and Early 2002 and Beyond) becomes public knowledge, Editor & Publisher’s Greg Mitchell answers the question, “[H]e sure did.” [Editor & Publisher, 4/20/2008]
Deploring the Military's Domination of the Airwaves - McCarthy continues: “That the news divisions of NBC, ABC, CBS, CNN, and Fox sanctioned this domination by military types was a further assault on what the public deserves: independent, balanced and impartial journalism. The tube turned into a parade ground for military men… saluting the ethic that war is rational, that bombing and shooting are the way to win peace, and that their uniformed pals in Iraq were there to free people, not slaughter them. Perspective vanished, as if caught in a sandstorm of hype and war-whooping. If the US military embedded journalists to report the war from Iraq, journalists back in network studios embedded militarists to explain it. Either way, it was one-version news.” McCarthy asks why no dissenters are allowed on the airwaves to counter the military point of view, a question answered by a CNN news executive (see April 20, 2003). McCarthy answers his own question: “In wartime, presumably, the message to peace activists is shut up or shut down.”
Viewers Unaware of Analysts' Business Connections - Presciently, considering the wide range of business connections exploited by the analysts and documented in the 2008 expose, McCarthy notes: “Viewers are not told of possible conflicts of interest—that this general or that one is on the payroll of this or that military contractor. Nor are they given information on whether the retired generals are paid for their appearances.”
Militaristic Newsmen - It is not just the retired officers who provide a militarist perspective, McCarthy observes, but the reporters and anchormen themselves. With examples of ABC’s Ted Koppel and NBC’s Brian Williams donning helmets before the cameras, or Fox’s Geraldo Rivera proclaiming in Afghanistan that “[W]e have liberated this country” (and his cameraman shouting, “Hallelujah!”), “the media are tethered to the military,” McCarthy writes. “They become beholden, which leads not to Pentagon censorship, as in 1991 (see October 10, 1990), but a worse kind: self-censorship” (see September 10, 2003).
For Us or Against Us - McCarthy concludes: “George W. Bush lectured the world that you’re either with us or against us. America’s networks got the message: They’re with. They could have said that they’re neither with nor against, because no side has all the truth or all the lies and no side all the good or evil. But a declaration such as that would have required boldness and independence of mind, two traits not much linked to America’s television news.” [Washington Post, 4/19/2003]

Vice President Dick Cheney is interviewed in his office by federal prosecutors as part of the Valerie Plame Wilson identity leak investigation (see December 30, 2003). Cheney is asked if he knows who, if anyone, in the White House might have leaked Plame Wilson’s identity to the press. He is asked about conversations with his senior aides, including his chief of staff, Lewis “Scooter” Libby. He is also asked whether he knows of any concerted effort by White House officials to leak Plame Wilson’s identity. Cheney is not questioned under oath, and has not been asked to testify before the grand jury. He is represented by two lawyers, Terrence O’Donnell and Emmet Flood. Cheney Evades, Refuses to Answer Questions - In October 2009, an FBI interview summary regarding Cheney’s testimony will be released (see October 1, 2009). According to the document, Cheney equivocates or refuses to answer 72 times during his interview, either saying he cannot be certain about the information requested, or that he does not know.
Denies Informing Libby about Plame Wilson's CIA Status - One of the most fundamental questions Cheney is asked is about how Libby learned about Plame Wilson’s identity. Libby’s own notes indicate that he learned it from Cheney, and that he had shared his notes with Cheney in late 2003 (see Late September or Early October, 2003), in defiance of instructions from the FBI and the White House counsel’s office not to share information with colleagues (see September 29-30, 2003). But in his testimony, Cheney “cannot recall Scooter Libby telling him how he first heard of Valerie Wilson. It is possible Libby may have learned about Valerie Wilson’s employment from the vice president… but the vice president has no specific recollection of such a conversation.” [Federal Bureau of Investigation, 5/8/2004 ; Associated Press, 11/2/2009] Cheney testifies that contrary to the evidence, he learned of Plame Wilson’s CIA status from Libby, who informed him that a number of reporters had contacted Libby in July 2003 to say that Plame Wilson had been responsible for arranging her husband’s trip to Niger to investigate the Niger uranium claims. Cheney says that the next time he heard about Plame Wilson and her connection to her husband was when he read Robert Novak’s article outing her as a CIA officer (see July 14, 2003). Cheney is lying; he informed Libby of Plame Wilson’s identity (see (June 12, 2003)).
Denies Knowledge of Wilson Trip to Niger - He also denies knowing that Plame Wilson’s husband, war critic and former ambassador Joseph Wilson, was sent to Niger to investigate claims that Iraq was attempting to buy uranium from that country (see (February 13, 2002) and February 21, 2002-March 4, 2002), and says the CIA never briefed him about Wilson’s trip (see March 5, 2002). Future testimony will challenge Cheney’s claims, as witnesses will testify that Cheney, Libby, Deputy National Security Adviser Stephen Hadley, the Defense Department, the State Department, the Defense Intelligence Agency, the Joint Chiefs of Staff, the National Security Council, and President Bush were all given copies of a CIA cable sent to Cheney’s office that debunked the Niger claims (see December 2001, Shortly after February 12, 2002, March 5, 2002, February 12, 2002, March 8, 2002, October 15, 2002, Mid-October 2002, October 18, 2002, January 2003, and March 8, 2003). Refuses to Answer about WMD NIE - Prosecutor Patrick Fitzgerald, leading the interview, presses Cheney to discuss evidence that shows he pressured Bush to quickly declassify portions of the October 2002 National Intelligence Estimate on Iraqi WMD (see October 1, 2002) for the purpose of making the case for invading Iraq. Libby provided selected NIE information to New York Times reporter Judith Miller while simultaneously leaking Plame Wilson’s identity to her (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003) and other reporters. Cheney refuses to confirm that he discussed anything regarding the NIE with Bush, saying that he could not comment on any private or privileged conversations he may have had with the president. Libby has already testified to the declassification of the NIE, telling prosecutors that he talked to Miller following the “president’s approval relayed to me through the vice president.”
Insists Plame Wilson's Identity Never Used to Discredit Husband - Cheney insists that no one in the White House ever talked about leaking Plame Wilson’s CIA status to the press in an attempt to discredit her husband. There was never any discussion, Cheney says, of “pushing back” on Wilson’s credibility by raising the issue of nepotism, the fact that his wife worked for the CIA, the same agency that dispatched him to Niger to run down the report of an agreement to supply uranium to Iraq. In his own testimony, Libby was far less emphatic, saying “[i]t’s possible” he may have discussed the idea with Cheney. Both men lie in their testimony (see March 9, 2003 and After, May 2003, June 3, 2003, June 9, 2003, June 11 or 12, 2003, (June 11, 2003), 12:00 p.m. June 11, 2003, 2:00 p.m. June 11, 2003, 5:27 p.m. June 11, 2003, (June 12, 2003), June 19 or 20, 2003, July 7, 2003 or Shortly After, July 7-8, 2003, 12:00 p.m. July 7, 2003, July 8, 2003, and 7:35 a.m. July 8, 2003). [Federal Bureau of Investigation, 5/8/2004 ; Associated Press, 11/2/2009] Cheney tells prosecutors that he and his office were merely interested in rebutting Wilson’s criticisms of the war effort, and wanted to dispel the notion among some reporters that he had selected Wilson for the Niger trip. In 2006, an attorney close to the case will say: “In his testimony the vice president said that his staff referred media calls about Wilson to the White House press office. [Source: CBS News]Retired Marine General Anthony Zinni was the chief of the US Central Command until 2000, and, until just before the invasion of Iraq, the Bush administration’s special envoy to the Middle East. Now he has become an outspoken critic of the administration’s war efforts in Iraq. Zinni gives an interview to CBS’s 60 Minutes, in part to promote his new biography, Battle Ready, co-authored by famed war novelist Tom Clancy.
'Dereliction of Duty' among Senior Pentagon Officials - Zinni says that senior officials at the Pentagon, from Defense Secretary Donald Rumsfeld on down, are guilty of what he calls dereliction of duty, and he believes it is time for “heads to roll.” Zinni tells correspondent Steve Kroft: “There has been poor strategic thinking in this. There has been poor operational planning and execution on the ground. And to think that we are going to ‘stay the course,’ the course is headed over Niagara Falls. I think it’s time to change course a little bit, or at least hold somebody responsible for putting you on this course. Because it’s been a failure.” In his book, Zinni writes: “In the lead up to the Iraq war and its later conduct, I saw at a minimum, true dereliction, negligence, and irresponsibility, at worse, lying, incompetence, and corruption.… I think there was dereliction in insufficient forces being put on the ground and fully understanding the military dimensions of the plan. I think there was dereliction in lack of planning.”
'The Wrong War at the Wrong Time' - Zinni calls Iraq “the wrong war at the wrong time,” and with the wrong strategy. Before the invasion, Zinni told Congress (see October 31, 2002): “This is, in my view, the worst time to take this on. And I don’t feel it needs to be done now.” The generals never wanted this war, Zinni says, but the civilians in the Pentagon and the White House did. “I can’t speak for all generals, certainly,” he says. “But I know we felt that this situation was contained (see Summer 2002-2003). Saddam was effectively contained.… And I think most of the generals felt, let’s deal with this one at a time. Let’s deal with this threat from terrorism, from al-Qaeda.”
Much Larger Force Required - Zinni was heavily involved in planning for any invasion of Iraq, going back to at least 1999 (see April-July 1999). Zinni always envisioned any such invasion as being implemented with enough ground forces to get the job done quickly and cleanly. Rumsfeld had different ideas—the invasion could be carried off with fewer troops and more high-tech weaponry. Zinni wanted around 300,000 troops: “We were much in line with General Shinseki’s view. We were talking about, you know, 300,000, in that neighborhood.” Would a larger force have made a difference? Kroft asks. Zinni replies, “I think it’s critical in the aftermath, if you’re gonna go to resolve a conflict through the use of force, and then to rebuild the country.” Rumsfeld should have anticipated the level and ferocity of violence that erupted in the aftermath of the toppling of the Hussein government, but, Zinni says, he did not, and worse, he ignored or belittled those such as Shinseki and a number of foreign allies who warned him of the possible consequences. Instead, Zinni notes, Rumsfeld relied on, among other sources, fabricated intelligence from Ahmed Chalabi and his Iraqi National Congress (see September 19-20, 2001).
'Seat of the Pants Operation' - The entire reconstruction effort was, in Zinni’s mind, a seat-of-the-pants affair. “As best I could see, I saw a pickup team, very small, insufficient in the Pentagon with no detailed plans that walked onto the battlefield after the major fighting stopped and tried to work it out in the huddle,” he says, “in effect to create a seat-of-the-pants operation on reconstructing a country.” Coalition Provisional Authority head L. Paul Bremer is “a great American who’s serving his country, I think, with all the kind of sacrifice and spirit you could expect. But he has made mistake after mistake after mistake.” Bremer’s mistakes include “Disbanding the army (see May 23, 2003). De-Baathifying (see May 16, 2003), down to a level where we removed people that were competent and didn’t have blood on their hands that you needed in the aftermath of reconstruction—alienating certain elements of that society.” Zinni reserves most of the blame for the Pentagon: “I blame the civilian leadership of the Pentagon directly.”
Heads Should Roll, Beginning with Rumsfeld's - Zinni continues: “But regardless of whose responsibility I think it is, somebody has screwed up. And at this level and at this stage, it should be evident to everybody that they’ve screwed up. And whose heads are rolling on this? That’s what bothers me most.” The first one to go, Zinni says, is Rumsfeld: “Well, it starts with at the top. If you’re the secretary of defense and you’re responsible for that.”
Neoconservatives at Fault - Next up are Rumsfeld’s advisers, whom Kroft identifies as the cadre of neoconservatives “who saw the invasion of Iraq as a way to stabilize American interests in the region and strengthen the position of Israel.” Zinni says: “Certainly those in your ranks that foisted this strategy on us that is flawed. Certainly they ought to be gone and replaced.” Kroft identifies that group as including Deputy Defense Secretary Paul Wolfowitz; Undersecretary of Defense Douglas Feith; former Defense Policy Board member Richard Perle; National Security Council member Elliott Abrams; and Vice President Cheney’s chief of staff, Lewis “Scooter” Libby. Zinni calls them political ideologues who have hijacked US policy in Iraq: “I think it’s the worst-kept secret in Washington. That everybody—everybody I talk to in Washington has known and fully knows what their agenda was and what they were trying to do.” Like so many others who criticized them, Zinni recalls, he was targeted for personal counterattacks. After publishing one article, he says: “I was called anti-Semitic. I mean, you know, unbelievable that that’s the kind of personal attacks that are run when you criticize a strategy and those who propose it.”
Fundamental Conceptual Flaws - Zinni says the neoconservatives believed they could remake the Middle East through the use of American military might, beginning with Iraq. Instead, the US is viewed in the region as “the modern crusaders, as the modern colonial power in this part of the world.”
Changing Course - Zinni has a number of recommendations. He advises President Bush and his senior officials to reach out much more strongly to the United Nations, and to US allies, and secure the UN’s backing. Do these other countries “want a say in political reconstruction? Do they want a piece of the pie economically? If that’s the cost, fine. What they’re gonna pay for up front is boots on the ground and involvement in sharing the burden.” Many more troops are needed on the ground, and not just American troops, he says, enough to seal off the borders, protect the road networks.
Exit Strategy - Zinni says that planning for an exit is necessary because it is inevitable that the US will want to withdraw, and that time will come sooner rather than later. “There is a limit,” he says. “I think it’s important to understand what the limit is. Now do I think we are there yet?”
Speaking Out - He is speaking out, he says, because it is his duty to do so: “It is part of your duty. Look, there is one statement that bothers me more than anything else. And that’s the idea that when the troops are in combat, everybody has to shut up. Imagine if we put troops in combat with a faulty rifle, and that rifle was malfunctioning, and troops were dying as a result. I can’t think anyone would allow that to happen, that would not speak up. Well, what’s the difference between a faulty plan and strategy that’s getting just as many troops killed?” [CBS News, 5/21/2004]

The Joint Chiefs of Staff publish a classified draft document, the Doctrine for Joint Nuclear Operations, laying out the rationale for the US’s use of nuclear weapons. It includes the possibility that nuclear weapons could be used during preemptive assaults on nations (see January 10, 2003) or even non-national organizations such as al-Qaeda. The draft states that nuclear weapons can be used:
Against an adversary intending to use WMD against US, multinational, or allies’ forces or civilian populations;
In the event of an imminent attack by biological weapons that only nuclear weapons can safely destroy;
To attack deep, hardened bunkers containing chemical or biological weapons or the command and control infrastructure required for the adversary to execute a WMD attack against the United States or its allies;
To counter potentially overwhelming adversary conventional forces;
For rapid and favorable war termination on US terms;
To ensure the success of US and multinational operations.
In essence, the document gives a green light for the US military, as ordered by President Bush, to use nuclear weapons under almost any circumstances, against much less powerful adversaries. Author J. Peter Scoblic will write: “The Bush administration was blurring, if not erasing, the line between conventional and nuclear weapons and lowering the threshold at which the nation would go nuclear, proposing an array of tactical uses for weapons that were supposed to only be used in strategic conflicts. The Bush Pentagon was effectively acknowledging that the United States might use nuclear weapons first, against a nonnuclear state, before any hostilities had taken place.” The document actually replaced the term “nuclear war” with “conflict involving nuclear weapons” because the first phrase implies that both sides in a conflict were using nuclear weapons, and in all likelihood any nuclear weapons deployed under the conditions envisioned in the document would only be American. William Cowan. [Source: The Intelligence Summit]Fourteen Marines die in Iraq. Hours after their deaths, William Cowan, a retired Marine colonel and Fox News analyst (see April 20, 2008 and Early 2002 and Beyond) who has grown increasingly uncomfortable with what he will later call the Pentagon’s “twisted version of reality” being pushed on analysts in briefings, telephones the Pentagon to advise officials that his upcoming comments on Fox “may not all be friendly.” He is then given a private briefing, quickly arranged by Defense Secretary Donald Rumsfeld’s senior aides. But Cowan then tells Fox host Bill O’Reilly that it has been “a bad week” in Iraq, that many military officials he has talked to were “expressing a lot of dismay and disappointment at the way things are going,” and the US is “not on a good glide path right now” in Iraq. The repercussions are almost immediate. According to Cowan, he is “precipitously fired from the analysts group” for this appearance. The Pentagon “simply didn’t like the fact that I wasn’t carrying their water.” Cowan later recalls: “Suddenly, boom, I never got another telephone call, I never got another e-mail from them.… I was just booted off the group. I was fired.” Cowan will say that he and other analysts were given special access only “as long as they thought I was serving their purposes.… I drink nobody’s Kool-Aid.” The next day, the other analysts take part in a conference call with General James Conway, the director of operations for the Joint Chiefs of Staff, where he urges them not to let the Marines’ deaths erode support for the war. Conway is blunt, saying directly that the US citizenry is the main target of Pentagon propaganda. “The strategic target remains our population,” he tells them. “We can lose people day in and day out, but they’re never going to beat our military. What they can and will do if they can is strip away our support. And you guys can help us not let that happen.” An analyst chimes in, “General, I just made that point on the air.” Conway says, “Let’s work it together, guys.” [New York Times, 4/20/2008; Washington Post, 4/21/2008]
President Bush orders the Joint Chiefs of Staff to draw up a contingency war plan for Iran that can be implemented, upon orders from the president, within 24 hours. A special planning group will be formed to carry out the assignment. The plan will initially focus on a bombing campaign targeting Iran’s nuclear facilities. It will also include a scheme for regime change.
After a major strategy shift takes place in early 2007 (see Late 2006), the plan will be revised to include targets in Iran believed to be involved in the supplying or aiding of militants in Iraq. [New Yorker, 3/5/2007]
Retired Marine Lieutenant General Gregory Newbold, until October 2002 the director of operations for the Joint Chiefs of Staff, is another in a small but vocal group of current and retired generals voicing public dissent against the Bush administration’s policies in Iraq. Newbold writes an op-ed for Time magazine, and leads off by saying that after Vietnam, he and other career military officers determined never again to “stand by quietly while those ignorant of and casual about war lead us into another one and then mismanage the conduct of it.” But, Newbold writes, it happened again. He takes responsibility for his own actions in planning for the invasion of Iraq, but notes that “[i]nside the military family, I made no secret of my view that the zealots’ rationale for war made no sense. And I think I was outspoken enough to make those senior to me uncomfortable. But I now regret that I did not more openly challenge those who were determined to invade a country whose actions were peripheral to the real threat—al-Qaeda.” Newbold retired from the military in late 2002, “in part because of my opposition to those who had used 9/11’s tragedy to hijack our security policy. Until now, I have resisted speaking out in public. I’ve been silent long enough.” The cost of the Bush administration’s “flawed leadership continues to be paid in blood,” he writes, and that blood debt drives him to speak out.
A Justifiable War - Invading Afghanistan was the right thing to do, Newbold says, to take on the Taliban and al-Qaeda. And though invading Iraq was unnecessary and wrong, he says, the US cannot now just withdraw precipitously: “It would send a signal, heard around the world, that would reinforce the jihadists’ message that America can be defeated, and thus increase the chances of future conflicts. If, however, the Iraqis prove unable to govern, and there is open civil war, then I am prepared to change my position.”
Outrage - Newbold writes of his deep anger at the words of Secretary of State Condoleezza Rice, who recently said that “we” made the “right strategic decisions,” but made thousands of “tactical errors” (see March 31-April 1, 2006). Newbold calls that statement “an outrage. It reflects an effort to obscure gross errors in strategy by shifting the blame for failure to those who have been resolute in fighting. The truth is, our forces are successful in spite of the strategic guidance they receive, not because of it.” Instead, he writes: “What we are living with now is the consequences of successive policy failures.… My sincere view is that the commitment of our forces to this fight was done with a casualness and swagger that are the special province of those who have never had to execute these missions—or bury the results.” Many of the Pentagon’s highest-ranking generals bear their own blame, Newbold writes, in “act[ing] timidly when their voices urgently needed to be heard. When they knew the plan was flawed, saw intelligence distorted to justify a rationale for war, or witnessed arrogant micromanagement that at times crippled the military’s effectiveness, many leaders who wore the uniform chose inaction.” Some few actually believed the rationale for war, others were intimidated, and many believed that their sense of duty and obedience precluded their speaking out. “The consequence of the military’s quiescence was that a fundamentally flawed plan was executed for an invented war, while pursuing the real enemy, al-Qaeda, became a secondary effort.” Many members of Congress, both Republicans and Democrats, “defaulted in fulfilling their constitutional responsibility for oversight.” Many media reporters, editors, and pundits ignored the warnings and instead played up the rationale for war.
New Visions, New Strategies - The first thing to do, says Newbold, is to fire Defense Secretary Donald Rumsfeld along with “many others unwilling to fundamentally change their approach.” The US owes their troops, living and dead, a debt of gratitude and the responsibility to “construct a unified strategy worthy of them. It is time to send a signal to our nation, our forces and the world that we are uncompromising on our security but are prepared to rethink how we achieve it.” More generals and others in positions of leadership need to speak out, Newbold concludes, and make sure that we as a nation are not “fooled again.” [Time, 4/9/2006]
Smarting from the media criticism sparked by the “Generals’ Revolt” and the subsequent revelation of Pentagon attempts to manipulate the media in response (see April 14-16, 2006), about 17 military analysts (see April 20, 2008 and Early 2002 and Beyond) meet with Defense Secretary Donald Rumsfeld and Joint Chiefs of Staff Chairman General Peter Pace. The subject, according to a transcript of the session, is how to marginalize war critics and pump up public support for the war. (Only Rumsfeld and Pace are identified by name in the transcript.) One analyst says bluntly: “I’m an old intel guy. And I can sum all of this up, unfortunately, with one word. That is Psyops [psychological operations]. Now most people may hear that and they think, ‘Oh my God, they’re trying to brainwash.’” Rumsfeld cuts the analyst off with a sarcastic comment: “What are you, some kind of a nut? You don’t believe in the Constitution?” Rumsfeld’s words draw laughter. Few of the participants discuss any of the actual criticism from the former generals.
'Illegal or Immoral'? - Interestingly, Rumsfeld acknowledges that he has been warned that his “information operations” are possibly “illegal or immoral.” He retorts: “This is the first war that’s ever been run in the 21st century in a time of 24-hour news and bloggers and internets and emails and digital cameras and Sony cams and God knows all this stuff.… We’re not very skillful at it in terms of the media part of the new realities we’re living in. Every time we try to do something someone says it’s illegal or immoral, there’s nothing the press would rather do than write about the press, we all know that. They fall in love with it. So every time someone tries to do some information operations for some public diplomacy or something, they say oh my goodness, it’s multiple audiences and if you’re talking to them, they’re hearing you here as well and therefore that’s propagandizing or something.” [US Department of Defense, 4/18/2006 ]
Iraq Losses 'Relative' in Comparison to 9/11 - The analysts, one after the other, tell Rumsfeld how “brilliant” and “successful” his war strategy is, and blame the news media for shaping the public’s negative opinion about the war. One participant says, “Frankly, from a military point of view, the penalty, 2,400 brave Americans whom we lost, 3,000 in an hour and 15 minutes [referring to the 9/11 attacks], is relative.” An analyst says: “This is a wider war. And whether we have democracy in Iraq or not, it doesn’t mean a tinker’s damn if we end up with the result we want, which is a regime over there that’s not a threat to us.” Rumsfeld agrees with the assessments. The biggest danger, the analysts agree, is not in Iraq, but in the public perceptions. The administration will suffer grave political damage if the perception of the war is not altered. “America hates a loser,” one analyst says.
'Crush These People' - Most of the session centers on ways Rumsfeld can reverse the “political tide.” One analyst urges Rumsfeld to “just crush these people,” and assures him that “most of the gentlemen at the table” would enthusiastically support him if he did. “You are the leader,” the analyst tells Rumsfeld. “You are our guy.” Another analyst suggests: “In one of your speeches you ought to say, ‘Everybody stop for a minute and imagine an Iraq ruled by al-Zarqawi.’ And then you just go down the list and say, ‘All right, we’ve got oil, money, sovereignty, access to the geographic center of gravity of the Middle East, blah, blah, blah.’ If you can just paint a mental picture for Joe America to say, ‘Oh my God, I can’t imagine a world like that.’” Several of the analysts want to know what “milestone” they should cite as the next goal; they want to, as one puts it, “keep the American people focused on the idea that we’re moving forward to a positive end.” The suggestion is to focus on establishing a new and stable Iraqi government. Another analyst notes, “When you said ‘long war,’ you changed the psyche of the American people to expect this to be a generational event.” They are also keenly interested in how to push the idea of a war with Iran. When the meeting ends, an obviously pleased Rumsfeld takes the entire group and shows them treasured keepsakes from his life.
Desired Results - The results are almost immediate. The analysts take to the airwaves and, according to the Pentagon’s monitoring system (see 2005 and Beyond), repeat almost verbatim the Pentagon’s talking points: that Rumsfeld is consulting “frequently and sufficiently” with his generals; that Rumsfeld is not “overly concerned” with the criticisms of his leadership; and that their briefing focused “on more important topics at hand,” including the next milestone in Iraq, the formation of a new government. Days later, Rumsfeld will write himself a memo distilling the analysts’ advice into bullet points. Two are underlined: “Focus on the Global War on Terror—not simply Iraq. The wider war—the long war” and “Link Iraq to Iran. Iran is the concern. If we fail in Iraq or Afghanistan, it will help Iran.”
'Total Disrespect' - At least one analyst is not pleased. ABC’s William Nash, a retired general, will recall, “I walked away from that session having total disrespect for my fellow commentators, with perhaps one or two exceptions.” [New York Times, 4/20/2008]
General John Abizaid testifies before the Senate Armed Forces Committee. [Source: Washington Note]General John Abizaid, the commander of US forces in the Middle East, tells the Senate Armed Services Committee that sectarian violence in Iraq, especially in and around Baghdad, has grown so severe that the nation may be on the brink of civil war. “A couple of days ago, I returned from the Middle East,” he says. “I’ve rarely seen it so unsettled or so volatile. There’s an obvious struggle in the region between moderates and extremists that touches every aspect of life.” He continues, “I believe that the sectarian violence is probably as bad as I’ve seen it, in Baghdad in particular, and that if not stopped, it is possible that Iraq could move towards civil war.” The New York Times reports that “the tone of the testimony at the Armed Services Committee’s three-and-a-half-hour hearing was strikingly grimmer than the Pentagon’s previous assessments, which have sought to accentuate the positive even as officials acknowledged that Iraq’s government was struggling to assert authority and assure security amid a tide of violence.” [New York Times, 8/4/2006; Washington Post, 8/4/2006]
Harsh Criticism of Rumsfeld - Abizaid is joined by Defense Secretary Donald Rumsfeld and General Peter Pace, the chairman of the Joint Chiefs of Staff. Rumsfeld had initially refused to attend the hearing, but agreed to attend after Senate Democrats criticized his refusal. Neither Rumsfeld nor Pace contradict Abizaid’s assessments, though Rumsfeld emphasizes that the war must not be lost. Pace notes that while civil war is possible, he does not believe it is “probable,” and Abizaid says he is “optimistic that that slide [into civil war] can be prevented.” Some of the harshest criticism of Rumsfeld comes from committee member Hillary Clinton (D-NY), who tells him that he failed to send enough troops to Iraq in the 2003 invasion “to establish law and order,” he erred by disbanding the Iraqi army, he failed to plan adequately for the occupation phase, and he “underestimated the nature and strength of the insurgency, the sectarian violence, and the spread of Iranian influence.” Now, she says, “we hear a lot of happy talk and rosy scenarios, but because of the administration’s strategic blunders and, frankly, the record of incompetence in executing, you are presiding over a failed policy. Given your track record, Secretary Rumsfeld, why should we believe your assurances now?” Rumsfeld responds, “My goodness,” and then says: “First of all, it’s true, there is sectarian conflict in Iraq, and there is a loss of life. And it’s an unfortunate and tragic thing that that’s taking place. And it is true that there are people who are attempting to prevent that government from being successful. And they are the people who are blowing up buildings and killing innocent men, women and children, and taking off the heads of people on television. And the idea of their prevailing is unacceptable.” Clinton will call for Rumsfeld’s resignation later in the day (see August 3, 2006). [New York Times, 8/4/2006; Washington Post, 8/4/2006]
'Whack-a-Mole' - Because of the continued instability in Iraq, Abizaid says, there is little possibility that US troops will be able to return home in any significant numbers before at least the end of the year. Instead, he says, more US troops will be deployed in and around Baghdad to contain the worsening violence in the capital, and warns that the US will undoubtedly suffer serious casualties in that operation. Acknowledging the necessity for US soldiers to stay in Iraq for the immediate future, Senator John McCain (R-AZ) finds the military’s practice of moving those soldiers from one violence-ridden part of Iraq to another little more than playing a game of “whack-a-mole.” McCain says, “What I worry about is we’re playing a game of whack-a-mole here,” with insurgent activity popping up in places that troops have vacated. “Now we’re going to have to move troops into Baghdad from someplace else. It’s very disturbing.” McCain will wholeheartedly endorse the idea of a “surge” of more American troops into Iraq (see January 2007 and January 10, 2007). The US commander for Europe, General James Jones, confirms that he made a damning quote to author Bob Woodward. In Woodward’s September, 2006 book State of Denial, Jones is quoted as saying that Defense Secretary Donald Rumsfeld had “systematically emasculated” the military’s leadership. Jones confirms to a Washington Post reporter that he indeed said those words to Woodward. According to the book, Jones, formerly the Marine Chief of Staff, called the war in Iraq a “debacle,” and added, “The Joint Chiefs have been systematically emasculated by Rumsfeld.” According to the book, Jones also told Marine General Peter Pace, who was about to become the chairman of the Joint Chiefs, “You should not be the parrot on the secretary’s shoulder.” Pace has denied that Jones made such a remark to him. Jones says that the quotes are correct—though he now says Iraq is less of a “debacle” than a “big problem”—but adds, “[H]ad I seen [the book], I probably would have suggested that the tone was more critical than I intended it to be.” Jones says: “I do not associate myself with the so-called revolt of the generals. I believe that general officers, both active and retired, have an obligation to let their views be known,” but should do so in a “helpful” way. Of his comments about Rumsfeld, he says, “We’re a team, we’re together, we have occasional family disagreements.” [Washington Post, 10/5/2006; Roberts, 2008, pp. 158, 247]
Details of ‘surge’ troop deployments . [Source: Jordan Times] (click image to enlarge)In a major policy speech regarding Iraq, President Bush announces that he will order 21,500 more US combat troops to Iraq, in a troop escalation he calls a “surge.” The bulk of the troops will be deployed in and around Baghdad. In addition, 4,000 Marines will go to the violent al-Anbar province. In announcing the escalation, he concedes a point he has resisted for over three years, that there have not been enough US troops in Iraq to adequately provide security and create conditions favorable for an Iraqi democracy to take hold. He admits that his previous strategy was based on flawed assumptions about the unstable Iraqi government. “Where mistakes have been made, the responsibility lies with me,” he says. Bush says that to consider any withdrawals of American troops would be a grave mistake, and that by increasing the number of troops in Iraq now, conditions will improve to a point at which troops can be withdrawn. “To step back now would force a collapse of the Iraqi government,” he says. “Such a scenario would result in our troops being forced to stay in Iraq even longer, and confront an enemy that is even more lethal. If we increase our support at this crucial moment, and help the Iraqis break the current cycle of violence, we can hasten the day our troops begin coming home.” Bush also commits the Iraqi government to meeting a series of “benchmarks,” tangible indicators of progress being made, that include adding a further 8,000 Iraqi troops and police officers in Baghdad, passage of long-delayed legislation to share oil revenues among Iraq’s ethnic groups, and a $10 billion jobs and reconstruction program, to be financed by the Iraqis. Bush aides insist that the new strategy is largely the conception of the Iraqi government, with only limited input from US planners. If successful, he says, the results will be a “functioning democracy” that “fights terrorists instead of harboring them.” [New York Times, 1/10/2007; ABC News, 1/10/2007; White House, 1/10/2007] While no one is sure how much the new policies will cost, Bush is expected to demand “billions” from Congress to fund his new escalation in the weeks ahead. 'New Way Forward' - The surge has a new marketing moniker, the “New Way Forward.” Some believe that the surge is more for political and public relations purposes than any real military effectiveness. “Clearly the deteriorating situation in Iraq is the overall background,” says political scientist Ole Holsti. The changes may indicate “they are looking for new bodies bringing fresh thinking…or you may have a kind of public-relations aspect,” to show Bush’s change in course is “more than just words.” [CBS News, 1/5/2007; USA Today, 1/5/2007]
Surge Already Underway - Interestingly, while Bush announces the “new” strategy of escalating the US presence in Iraq tonight, the escalation is already well underway. 90 advance troops from the Army’s 82nd Airborne are already in Baghdad, and another 800 from the same division are en route. The escalation will necessitate additional call-ups from the National Guard as well as additional reactivation of troops who have already toured Iraq and Afghanistan. Additionally, the naval group spearheaded by the aircraft carrier USS Stennis will shortly be en route to the Persian Gulf. Whether the new plan will work is anyone’s guess, say military commanders in Iraq. The escalation will take several months to implement and longer to see tangible results. One military official says, “We don’t know if this will work, but we do know the old way was failing.”
Contradicting Previous Assertions - In announcing the surge, Bush contradicts the position he has asserted since the March 2003 invasion—that military commanders were determining the direction of the war effort. Bush has repeatedly spoken of his disdain for micromanaging the war effort, and has said that he won’t second-guess his commanders. “It’s important to trust the judgment of the military when they’re making military plans,” he said in December 2006. “I’m a strict adherer to the command structure.” However, Bush balked at following the advice of many top military officials and generals, who have recommended a gradual drawdown in troop strengths, and in recent weeks replaced several top military officials who expressed doubts about the need or efficacy of new troop deployments in Iraq (see January 5, 2007). Instead, Bush believes the escalation will alleviate the drastically deteriorating security situation in Iraq. According to Pentagon officials, the Joint Chiefs of Staff, who oppose the surge, have agreed to support it only grudgingly, and only because Bush officials have promised a renewed diplomatic and political effort to go along with the escalation. Outgoing Central Command chief General John Abizaid said in November that further troop increases were not a viable answer to the Iraq situation, and in their November 30 meeting, Iraqi prime minister Nouri al-Maliki did not ask Bush for more troops, instead indicating that he wanted Iraqi troops to take a higher profile. Viewpoints differ on Bush’s interaction with his commanders up to this point—some have seen him as too passive with the generals and military advisers, allowing them almost free rein in Iraq, while others see him as asserting himself by forcing the retirements or reassignments of generals who disagree with his policies.
Rebuffing the ISG - Many observers believe the surge is a backhanded rebuff to the Iraq Study Group (see January 10, 2007).
Surge Plan Concocted at Right-Wing Think Tank - Interestingly, the surge plan itself comes largely from neoconservative planners at the American Enterprise Institute (see January 2007).
Long-Term Ramifications - The Joint Chiefs worry that a troop escalation will set up the US military for an even larger failure, without having any backup options. The Iraqis will not deliver the troops necessary for their own security efforts, they believe, and worry that US troops will end up fighting in what amounts to a political vacuum unless Bush comes up with a plan for dramatic political and economic changes to go along with the military effort. A surge could lead to increased attacks by Iraqi al-Qaeda fighters, open the troops up to more attacks by Sunni insurgents, and fuel the jihadist appeal for more foreign fighters to battle US forces in Iraq. And the escalation’s short-term conception—to last no more than six to eight months—might well play into the plans of Iraq’s armed factions by allowing them to “game out” the new strategy. The JCS also wonder just where Bush will find the troops for the surge. Frederick Kagan, one of the architects of the surge plan, and Republican presidential candidate John McCain want far more than 20,000 troops, but the Joint Chiefs say that they can muster 20,000 at best, and not all at once. Rumsfeld’s replacement, Robert Gates, played a key role in convincing the Joint Chiefs to support the escalation. The biggest selling point of the escalation is the White House’s belief that it will portray the administration as visibly and dramatically taking action in Iraq, and will help create conditions that will eventually allow for a gradual withdrawal of US troops: Bush says, “[W]e have to go up before we go down.” [Washington Post, 1/10/2007]

[Source: US Air Force]The US Air Force sets up a secret strategic planning group, nicknamed “Project Checkmate,” tasked with “fighting the next war” against Iran. Project Checkmate, a successor to the group that planned the 1991 Gulf War’s air campaign, reports directly to the Air Force’s commander, General Michael Moseley, and consists of twenty to thirty senior USAF officials as well as defense and cyberspace experts with strong access to the White House, the CIA, and other intelligence agencies. While planning for war with Iran began two years ago in Washington, the strategic planning group represents a serious escalation of planning and perhaps intent by the Bush administration and the US military. Checkmate is envisioned to modernize the stratified strategic thinking that often results in the US military “fighting the last war” over again, and intends to provide innovative strategies for tactical battles using air, space, and even cyberwarfare. The leader of Checkmate is Brigadier General Lawrence “Stutz” Stutzriem, and is assisted by former Israeli military officer Dr. Lani Kass, an expert on cyberwarfare. George W. Bush has said repeatedly that he prefers diplomacy with Iran over military action, but if Iran continues to work towards developing a nuclear weapon, as he and his top advisers believe, then he will consider aggressive, pre-emptive military action. However, Bush faces strong opposition from his own Joint Chiefs of Staff: “None of them think it is a good idea, but they will do it if they are told to,” says one senior defense source.
Aftermath the Biggest Problem - Retired Air Force Lieutenant General Thomas McInerney warns that the administration must seriously consider the aftermath of such a military offensive against Iran. “There is no question that we can take out Iran,” he says. “The problem is the follow-on, the velvet revolution that needs to be created so the Iranian people know it’s not aimed at them, but at the Iranian regime.” Checkmate, which is also looking at military contingencies against China and North Korea, was originally formed in the 1970s to counter threats from the then-Soviet Union, but fell into disuse in the 1980s when the Soviet Union began showing signs of internal collapse. Checkmate was revived under Colonel John Warden in 1990 to draw up plans for air strikes against Iraq in the 1991 Gulf War. “When Saddam [Hussein] invaded Kuwait, we had access to unlimited numbers of people with expertise, including all the intelligence agencies, and were able to be significantly more agile than Centcom,” Warden says, referring to the US Central Command in Florida. Warden says Checkmate’s primary role is to develop the necessary expertise so that “if somebody says Iran, it says: ‘here is what you need to think about.’ Here are the objectives, here are the risks, here is what it will cost, here are the numbers of planes we will lose, here is how the war is going to end and here is what the peace will look like.” [London Times, 9/27/2007]

The US Defense Department admits that it lacks a strategy for victory in Afghanistan even as it prepares to deploy 17,000 additional troops to that beleaguered country, but it has made some recommendations to change the US strategy there. Last week, during President Obama’s meeting with Defense Secretary Gates and the Joint Chiefs of Staff, Obama asked, “What is the end game” in the military’s strategy for Afghanistan? According to one military official present in the briefing, the response was, “Frankly, we don’t have one.” Senior military officials confirm that the Joint Chiefs have delivered a classified memo to Obama that recommends refocusing the military’s mission in Afghanistan to defeating al-Qaeda and the Taliban, and leaving the “hearts and minds” aspect of the war to other US agencies—particularly the State, Justice, and Agriculture Departments—and NATO. “This is a classic counnterinsurgency strategy, but the military cannot do it alone,” says one official. The officials admit that the Taliban “has definitely gained the upper hand” in some areas of Afghanistan, particularly the south, because there’s just too much territory and too few American forces to “clear and hold” an area. “The Taliban is no match” for US forces, the officials say, but once the Americans drive the Taliban from a region, then leave, the Taliban immediately filter back in and regain control. “In many remote areas, the Taliban have established ‘shadow governments’ and in some cases gained the confidence and support of the locals,” says an official. “We need a strategy that will convince the Afghan people [in the remote areas] that the Taliban’s extremism is no longer attractive as a government or a career,” the officials say. Such a strategy must increase Afghan security, then establish strong, fair local governments and create jobs and educational opportunities. “But that is not the military’s job,” one military official says. “We can build the schools, we can build the courthouses, but we cannot help them establish the good governance, justice and educations systems” that are needed. The new strategy also targets the Afghani drug trade, and loosens the previous rules of engagement that only allowed for eradication of poppy fields and confrontation with drug lords after it had been established that those activities were directly connected to the Taliban or al-Qaeda. The new rules assume any drug activities help the insurgency and are, therefore, “fair game.” [MSNBC, 2/4/2009]
Admiral Michael Mullen, the chairman of the Joint Chiefs of Staff, says that Iran most likely has enough fissile material to make a nuclear weapon. When asked by CNN’s John King whether Iran “might now have enough fissile material to make a bomb,” Mullen replies, “We think they do, quite frankly.” He adds, “Iran having a nuclear weapon, I believe, for a long time, is a very, very bad outcome for the region and for the world.” A spokesman for Mullen later “clarifies” his remarks to emphasize that Mullen was talking about “low-grade” material, and notes that for such to be used in a nuclear weapon, it would need to be highly enriched. Defense Secretary Robert Gates contradicts Mullen, saying that Iran is “not close to a weapon at this point” (see March 1, 2009), a point with which both the International Atomic Energy Agency (IAEA) and the Director of National Intelligence, Dennis Blair, agree. After Mullen’s interview, his spokesman, Captain John Kirby, tells CNN: “There are two components here: having enough and having it highly enriched. The chairman concurs Iran has enough low-enriched to produce a nuclear weapon, but it’s important to note it’s low-grade, and to enrich it would take time.” Iran has recently tested its first nuclear power plant, using dummy fuel rods that did not produce a nuclear reaction. General Martin Dempsey, chairman of the Joint Chiefs of Staff, says that Bradley Manning, the alleged leaker of a large number of documents published by WikiLeaks, violated the law. Dempsey makes the remarks at a members’ town hall meeting at Joint Base Pearl Harbor-Hickam, in response to a question about whether Manning should be viewed as a political prisoner, whistleblower, or traitor. “We’re a nation of laws,” says Dempsey. “He did violate the law.”
Manning is awaiting court martial, but has not yet been found guilty. [Honolulu Star-Advertiser, 3/10/2012] President Barack Obama made similar remarks the previous year (see Shortly Before April 22, 2011).
