Theresa LePore, the supervisor of elections for Palm Beach County, decides to use an unusual design for the upcoming election ballots. Because of a recent amendment to the Florida Constitution that makes it far easier for third-party and independent candidates to appear on the ballot for president, LePore has 10 presidential and vice-presidential candidates to fit on the ballot. She consulted with elections board employee Tony Enos; the two decided that a one-page ballot would have to use a typeface so small that many voters with vision problems would be unable to read the names. Instead, LePore chooses a two-page, or “facing page,” ballot design. She wants all 10 presidential candidates on the same page, so she goes with a design that has groups of candidates on either page and punchable holes in the center, in a vertical row: the voter will punch out the hole designated for his or her candidate. The design lists Republican candidates George W. Bush and Dick Cheney first on the left-hand page, with the punch hole designated for them also first; Reform Party candidates Pat Buchanan and Ezola Foster are first on the right-hand page, with their designated punch hole second; Democratic candidates Al Gore and Joseph Lieberman are second on the left-hand page, with their designated punch hole third. To many voters, the second punch hole designated for Buchanan and Foster will appear to be the hole designated for Gore and Lieberman (see November 9, 2000). (Tapper 3/2001)
During the vice presidential debates, both Joseph Lieberman and Dick Cheney advocate a tough stance toward Saddam Hussein. Lieberman says he and Gore would continue to support Iraqi opposition groups “until the Iraqi people rise up and do what the people of Serbia have done in the last few days: get rid of a despot.” Cheney says it might be necessary “to take military action to forcibly remove Saddam from power.” (CATO Daily Dispatch 10/6/2000)
During the single vice-presidential debate of the campaign, between Republican Dick Cheney and Democrat Joseph Lieberman, Cheney makes a number of assertions about his business experience that Lieberman does not challenge. No specific question is asked about Cheney’s tenure as CEO of Halliburton, but one is asked by the moderator, PBS newscaster Jim Lehrer, about “partisanship.” In the words of authors Lou Dubose and Jake Bernstein: “Cheney used his answer to burnish a myth that largely exists to this day. In it, he stars as the triumphant CEO, a self-reliant insider-turned-outsider who competently and ethically grew his company while increasing shareholder value. While politically useful, it happens to be a lie.” In the debate, Cheney says: “I’ve been out of Washington for the last eight years and spent the last five years running a company [sic] global concern. And been out in the private sector building a business, hiring people, creating jobs. I have a different perspective on Washington than I had when I was there in the past.” Dubose and Bernstein will note that Lieberman, a pro-corporate politician himself, fails to challenge Cheney’s self-assessment. Lieberman does make one wry observation: when Cheney challenges the common wisdom that most Americans are financially better off now than at the beginning of President Clinton’s tenure, Lieberman retorts: “I think if you asked most people in America today that famous question that Ronald Reagan asked, ‘Are you better off today than you were eight years ago?’ Most people would say yes. I’m pleased to see, Dick, from the newspapers that you’re better off than you were eight years ago, too.” Cheney replies, “I can tell you, Joe, the government had absolutely nothing to do with it.” Dubose and Bernstein call Cheney’s retort “a whopper of a falsehood—and one more that Lieberman failed to dispute.” Cheney has become a multi-millionaire during his tenure at Halliburton, and will continue to receive compensation from the firm years after he becomes vice president. During Cheney’s five-year term as Halliburton CEO, the company had suffered due to what Fortune magazine will call his “poor leadership.” However, the large profits Halliburton made under Cheney came largely from government contracts. In Palm Beach County, Florida, voters begin complaining of problems with the “butterfly ballot” almost as soon as the polls open. Many believe that the ballot’s confusing design is redirecting voters who want to vote for Democrat Al Gore to vote instead for Reform Party candidate Patrick Buchanan (see September 2000).
Alerting the Gore Campaign of Problems - Lawyer Liz Hyman, volunteering to work the election in Palm Beach for the Gore campaign, later recalls that starting at 7:00 a.m., voters approach her complaining about the ballot, some theorizing that someone or some group of people conspired to redirect Gore’s votes to Buchanan. Around 8:00 a.m., Hyman calls her father, Washington, DC, attorney Lester Hyman. “You’re not going to believe what’s going on down here,” she tells him, and advises him to alert someone at the national Gore campaign headquarters. Soon, Joe Sandler, the general counsel of the Democratic National Committee (DNC), contacts Liz Hyman in Palm Beach. During the same time period, a number of elderly, angry voters drive to election supervisor Theresa LePore’s office and demand an explanation for the ballot confusion, but LePore refuses to take their complaints seriously.
Complaints, Attempts to Clarify Voting Procedures - Poll clerk Ethel Brownstein, after seeing voters having difficulty casting their votes for Gore, begins telling voters at her precinct: “Please be careful. The first hole is [Republican George W.] Bush, the second is Buchanan, and the third is Gore.” The complaints keep coming in, with many voters worried that they have voted for Buchanan instead of their intended vote for Gore. Many voters punch the second hole, then reconsidering, punch the third hole also, inadvertently causing an “overvote” that will be discarded. Some voters even write “Gore” or draw arrows to indicate their selection. By 11:24 a.m., LePore receives a faxed letter from Bobby Brochin, the DNC’s counsel in Florida. Brochin, who is still unsure of the exact nature of the problem with the ballots, writes: “Apparently certain presidential ballots being utilized in several precincts in Palm Beach County are quite confusing. They contain two pages listing all of the presidential candidates, which may cause electors to vote twice in the presidential race. You should immediately instruct all deputy supervisors and other officials at these precincts that they should advise all electors (and post a written advisory) that the ballot for the presidential race is two pages long, and that electors should vote for only one presidential candidate.” LePore does not respond to Brochin’s fax. By noon, WPEC-TV is reporting on the “butterfly ballot” confusion, and, in author Jake Tapper’s words, “doing a hell of a lot better than the Democrats are” in explaining the issue. Gore campaign workers begin visiting precincts to explain to Gore voters how to properly cast their votes on the ballot. By the afternoon, early results show some dismaying returns.
'I Think I Voted for a Nazi' - Precinct 162-G, almost entirely composed of the Jewish retirement community Lakes of Delray, is showing a surprisingly large number of votes for Buchanan, a Holocaust denier who is roundly despised among most Jewish voters. Brochin resends his fax to LePore at 2:57 p.m., noting that he failed to get a response the first time. Gore campaign workers in the county re-record their TeleQuest phone-bank message with instructions on how to cast votes for Gore, and instructing voters who believe they may have miscast their votes to return to their polling places and make a complaint. Talk show host Randi Rhodes, an outspoken liberal who lives in the county, tells listeners on her afternoon radio show: “I got scared I voted for Pat Buchanan. I almost said, ‘I think I voted for a Nazi.’ When you vote for something as important as leader of the free world, I think there should be spaces between the names. We have a lot of people with my problem, who are going to vote today and didn’t bring their little magnifiers from the Walgreens. They’re not going to be able to decide that there’s Al Gore on this side and Pat Buchanan on the other side.… I had to check three times to make sure I didn’t vote for a fascist.”
Late Afternoon Advisory - This afternoon, Harold Blue, a World War II veteran who like his wife is legally blind, realizes after he cast his vote that a poll worker improperly instructed he and his wife to vote for Buchanan and not Gore. When Democratic officials like State Representative Lois Frankel, State Senator Ron Klein, and US Representative Robert Wexler visit the Palm Beach elections offices to find out what is going on, LePore begins to believe that there may be a serious problem with the “butterfly ballots.” She reluctantly agrees to write an advisory for the various precincts, but says she lacks the staff to distribute it; if the Democrats want it posted, they will have to deliver the advisory themselves. LePore’s advisory reads, “ATTENTION ALL POLL WORKERS PLEASE REMIND ALL VOTERS COMING IN THAT THEY ARE TO VOTE FOR ONLY ONE (1) PRESIDENTIAL CANDIDATE AND THEY ARE TO PUNCH THE HOLE NEXT TO THE ARROW NEXT TO THE NUMBER NEXT TO THE CANDIDATE THAT THEY WISH TO VOTE FOR.” Judge Charles Burton, a Republican member of the canvassing board, says he cannot understand the confusion, that the ballot clearly indicates by an arrow which hole is designated for Gore. Democratic board member Carol Roberts counters by warning Burton and LePore that some people are beginning to say the ballot may be illegal, and advises LePore to contact her own attorney. Burton says the ballot is clearly legal according to his interpretation of Florida election statutes, and that the law Democrats are citing—101.153(3)(a)—applies only to paper ballots, not punch-card ballots.
'File an Affidavit' - At 5:30 p.m., Democratic vice presidential contender Joseph Lieberman calls Rhodes in a prearranged “get out the vote” interview. The discussion quickly turns to the Palm Beach ballot confusion, and Rhodes urges Lieberman to consider “filing an affidavit,” presumably to contest the Palm Beach results. Florida lawyer Mitchell Berger is preparing to do just that, telling Brochin and other Democratic lawyers to prepare for court battles. (Tapper 3/2001)
The Gore campaign sends a quick-response team led by Al Gore’s former chief of staff, lawyer Ron Klain, to Florida to deal with the uncertainty of the Florida presidential race (see Early Morning, November 8, 2000). Almost immediately, Klain and his group are inundated with rumors of voting irregularities—understaffed polling places in Democratic strongholds, Democratic voters sent on “wild goose chases” to find their proper polling places, African-Americans illegally prevented from voting (see November 7, 2000), police roadblocks set up to keep voters from reaching their polls (see 11:30 a.m. November 7, 2000). Klain and his group are unable to ascertain the truth or fiction behind some of the rumors, though they learn about one that is verifiable—the problems surrounding Palm Beach County’s “butterfly ballot” that seem to have cost Gore some 2,600 votes (see November 9, 2000). Klain and the Gore campaign’s Florida head, Nick Baldick, learn that 10,000 votes for both candidates in Palm Beach have been set aside, uncounted, because of their classification as “undervotes”—votes that record no choice for president. Some 4 percent of Palm Beach voters cast their votes for senator but not for president, according to the machine scoring, a conclusion Klain and Baldick find hard to believe. They soon learn that many more “undervotes” were set aside in Miami-Dade County, like Palm Beach a Democratic stronghold. Broward County, which includes the heavily Democratic Fort Lauderdale region, is the source of a number of rumors concerning missing ballot boxes and unbelievable precinct totals. And Volusia County, another expected mine of Gore voters, initially reported a total of negative 16,000 votes for Gore. The automatic recount triggered by Florida law would not address any of these issues; manual recounts and human examination of ballots would be required to sort through the inconsistencies. Klain asks a number of Florida lawyers for legal advice and finds little help: the lawyers he contacts tell him that they are reluctant to give too much aid to the Gore campaign. “All the establishment firms knew they couldn’t cross Governor [Jeb] Bush [brother of presidential candidate George W. Bush] and do business in Florida,” Klain will later recall. Klain instead pulls together an ad hoc team to be led by former Secretary of State Warren Christopher, now a lawyer in Los Angeles. Gore chooses Christopher because he believes Christopher will lend the team an image of decorous, law-abiding respectability. But, according to a 2004 Vanity Fair report, “Christopher set a different tone, one that would characterize the Democrats’ efforts over the next 35 days: hesitancy and trepidation.” One of Christopher’s first statements on the situation is given to Gore’s running mate Joseph Lieberman, with Christopher saying: “I think we should be aggressive in asserting our position. But we’ve got to temper what we do with the realization that the nation is focused on us and is expecting to act responsibly.” The Bush campaign’s approach is very different from that taken by the sometimes-timorous Christopher. Their quick-response campaign team is headed by Texas lawyer James Baker, a close Bush family friend and another former secretary of state. As Vanity Fair will write, the Bush team “dug in like a pit bull,” issuing frequent press statements that hew to the same line: Bush won the vote on the morning of November 8 (see 2:15 a.m. November 8, 2000 and After 3:30 a.m. November 8, 2000) and therefore is the legitimate president. Any attempts to alter that “fact” amount to “mischief.” Privately, Baker worries that the narrative is untenable, telling his team: “We’re getting killed on ‘count all the votes.’ Who the hell could be against that?” The Gore campaign will ask for manual recounts in four counties, Palm Beach, Broward, Miami-Dade, and Volusia (see November 9, 2000), and the choice of selective recounts, as opposed to asking for statewide recounts, gives Baker the opening he is looking for. A surprisingly high number of voters in Palm Beach County, Florida, cast their presidential votes for third-party presidential candidate Patrick Buchanan, and the Gore campaign believes many of these voters intended to vote for Al Gore (see 7:00 a.m. November 7, 2000 and After). The problem lay in Palm Beach’s “butterfly ballot,” designed by Democratic county elections supervisor Theresa LePore, which many voters found confusing (see September 2000). The ballot gave a list of names for offices with corresponding holes to punch, but in the presidential race, Gore’s name lined up more closely with the hole designated for Buchanan, who won 3,407 votes in Palm Beach, over 2,600 more than he won in any other county in Florida. Palm Beach is heavily populated with elderly Jewish voters who were, media reports will say, thrilled to cast their votes for Gore’s Jewish running mate Joe Lieberman; it is doubtful they would have become enthused about Buchanan and his history of anti-Semitism and Holocaust trivialization. Bush spokesman Ari Fleischer attempts to characterize Palm Beach as a “Buchanan stronghold.” But Buchanan readily admits that the Gore campaign is probably correct in saying that many Palm Beach voters intended to vote for Gore and not for him. (Margolick, Peretz, and Shnayerson 10/2004; Leip 2008) “It does seem to me that those are probably not my votes in those precincts in Palm Beach County,” Buchanan says. “My guess is that I probably got some votes down there that really did not belong to me. I feel—I do not feel well about that. I do not want to take any votes that don’t belong to me.… If the two candidates they pushed were Buchanan and Gore, almost certainly those are Al Gore’s votes, not mine.” Representative Mark Foley (R-FL) says that the Palm Beach voters “may be deranged” in voting for Buchanan, “but they have every right to vote for him” and their votes should not be questioned. Three Palm Beach voters file a lawsuit “seeking a new election claiming the punchcard ballot was so confusing that they accidentally voted” for Buchanan. It is not clear if the Gore campaign or local Democratic Party officials will ask for an actual recount, though some Democratic lawyers call the ballot design “illegal.” (National Journal 11/9/2000)
Analyses: Ballot Confusion Cost Gore between 6,600 and 13,000 Votes - A subsequent analysis reported by the liberal news site Consortium News later alleges that Gore may have lost as many as 13,000 votes due to the “butterfly ballot.” Some voters say they attempted to vote for Gore, punched the hole for Buchanan by mistake, and attempted to correct the error by punching a second hole for Gore. The voting machines recorded those votes as “overvotes” and discarded them without counting them for either Gore or Buchanan. There may be over 10,000 of these particular overvotes remaining to be counted. 19,120 ballots in Palm Beach were disqualified because of double-voting, or “overvoting.” A sample of 144 ballots will be analyzed by Palm Beach election officials, and the results will show that 80 of those 144 ballots—56 percent—show punches for both Buchanan and Gore. If this sample accurately reflects the state of the remaining overvote ballots, then mathematically, Gore lost some 10,622 votes because of the confusion. Adding the approximately 2,700 votes that were given to Buchanan means that Gore lost some 13,000 votes in Palm Beach. (Consortium News 11/22/2000) A 2001 investigation by The Nation will find that the “lost” Gore votes in Palm Beach number somewhat less than the Consortium News estimate: some 6,600 votes that likely would have gone to Gore were either not counted or inadvertently given to Buchanan. According to media analyses performed by the Center for American Progress (CAP) and by the team of Kathleen Hall Jamieson and Paul Waldman, the Sunday talk show coverage of the Bush-Gore conflict in Florida between November 12 and December 10 is heavily skewed towards painting George W. Bush as the legitimate president (see After 3:30 a.m. November 8, 2000) and Al Gore the losing contender who continues to carry on after having legitimately lost the election. On December 3 and December 10, panelists on ABC’s This Week refer to Bush’s future presidency 27 times. Tim Russert, the host of NBC’s Meet the Press, does so 19 times and calls Bush’s running mate Dick Cheney the “vice president.” In a December 3 interview, Russert asks Cheney if he feels Gore is being a “sore loser” (see November 24, 2000 and After). On December 3, ABC’s Sam Donaldson attempts to get Gore’s running mate, Joseph Lieberman, to concede the election on-air. ABC’s Cokie Roberts attempts to get a concession from Gore campaign representative George Mitchell. Jamieson and Waldman later determine that in the five Sunday shows aired by the three networks during this time period, the word “concede” appears in 23 questions. In 20 of these questions, the hypothetical conceder is Gore. In the other three questions, the hypothetical conceder is no one. Similarly, the hosts and guests on these talk shows, and on other network news broadcasts, frequently warn of “dire consequences” to America’s constitutional democracy if the Florida question is not settled immediately. The hosts also issue frequent warnings that the citizenry’s patience is at “the breaking point,” though polls consistently show that most Americans are content to let the recall process work itself out. CAP later notes, “The Baker-Bush team [referring to James Baker, the head of the Bush campaign’s ‘quick response’ recount team—see Mid-Morning, November 8, 2000] worked hard to create this crisis atmosphere in the hopes of increasing the pressure on Gore to relent for the good of the country, the markets, and the maintenance of world peace.” During this time period, Russert tells viewers, “We could have chaos and a constitutional crisis.” NBC’s Tom Brokaw tells viewers: “If the Florida recount drags on, the national markets are at risk here. National security is involved.” Pundits on ABC’s This Week warn of “turmoil” if Gore does not concede; pundits on CBS’s Face the Nation remark on “spinning out of control.” Columnist David Broder says this period of US history is worse than the turmoil the country weathered after the assassination of President John F. Kennedy. (Alterman 12/9/2010)
Officials in Palm Beach County vote 2-1 to delay their manual recounts of their election ballots (see November 11-12, 2000) until they are able to clarify whether they have the legal authority to proceed. Florida Secretary of State Katherine Harris, the co-chair of Florida’s Bush campaign team (see After 3:30 a.m. November 8, 2000 and After), has rejected requests to extend the election certification deadline past 5:00 p.m. today (see 9:00 a.m. November 13, 2000). (Whitman et al. 12/13/2000; Leip 2008) Harris actually issues an order stopping the recounts, but her order is almost immediately countermanded by Florida Attorney General Robert Butterworth (Dickenson 11/19/2000) , who serves as the Gore campaign’s Florida chairman. (National Journal 11/9/2000) The canvassing board meeting is contentious. The lead Republican counsel, Mark Wallace, demands that County Commissioner Carol Roberts recuse herself from the board because of her “active” involvement in the Gore campaign. Roberts responds that her activity includes having a Gore bumper sticker on her car and attending a single cocktail party for Joe Lieberman, Al Gore’s running mate. Election observer Steven Meyer, working with the Democratic Party, writes that he has never heard Republicans complain about Harris’s involvement as co-chair of the Bush campaign. Elections Supervisor Theresa LePore has come under intense scrutiny and criticism for the controversial “butterfly ballot” that she approved for use in the county (see September 2000); many county Democrats blame her for what they believe were some 10,000 votes that should have gone to Gore (see November 9, 2000). Some board members, including LePore, have received death threats; whether these threats came from Republicans, Democrats, or others is unknown. Meyer observes that Republicans such as Wallace mount incessant complaints about ballot handling, and issue frequent demands that already-counted stacks of ballots be recounted again because someone touched or handled them inappropriately. Meyer observes Republican observers using tweezers to pick up tiny “chads” (paper rectangles discarded when a voter punches through a punch-card ballot to cast a vote) and place them in plastic baggies. He also notes that Republicans have placed thousands of Gore ballots in the “questionable” stacks when the ballots plainly indicate votes for Gore. (Meyer 12/14/2000)
The Bush and Gore campaigns begin a weeks-long wrangle over the issue of Florida’s absentee ballots. The deadline for counting absentee ballots received from citizens overseas is November 17 (see 12:00 a.m., November 17, 2000). Rumors of large numbers of military absentee ballots, presumably favoring Bush in number, and a large number of ballots from American Jews in Israel, presumably favoring Gore, have swirled for days among the media and in both campaigns. Gore campaign lawyer Mark Herron compiles a long memo on the rules governing absentee ballots to Democratic lawyers at each of the 67 county canvassing boards; a copy of the memo is obtained by a Republican legal team, and soon Bush spokespersons are quoting from it to accuse the Gore campaign of attempting to disenfranchise Americans in uniform. The Gore campaign sends vice-presidential candidate Joe Lieberman (D-CT) onto the Sunday morning television talk shows to shore up its position, and Lieberman protests that the campaign would never do anything to disenfranchise soldiers. Lieberman says that in his opinion, the most permissive standards should be applied to the absentee ballots. Herron and other Gore lawyers are dismayed by Lieberman’s position, as these standards would admit a larger influx of absentee ballots, the majority of which they believe will go to Bush. Okaloosa County, a Panhandle county with six military bases, becomes a center of the controversy. Lawyers from both campaigns and both parties attempt to wrangle the issue among themselves and the Okaloosa elections board, often becoming pushy and confrontational. Bush lawyers insist that the rules should be, in essence, jettisoned and all absentee ballots admitted regardless of postmarks, valid numbers and addresses, etc.; Okaloosa elections supervisor Pat Hollarn, a centrist Republican, refuses. “I told them not only no but hell no,” she later recalls. A 2004 Vanity Fair article will note, “At the same time, in the more Democratic counties, Bush lawyers were arguing just as passionately that rules should be strictly adhered to and any questionable ballots put aside.” After the wrangling has settled and the ballots are counted (see 12:00 a.m., November 17, 2000), Bush wins a net gain of 123 votes. Democratic vice-presidential candidate Joe Lieberman (D-CT) says on CBS’s Face the Nation that every last vote should be counted in Florida, or millions of citizens will say, “We were robbed.” (Whitman et al. 12/13/2000) Lieberman later tells reporters, referring to the Bush campaign, “It seems to be that they’re doing everything they can to stop the recounting of votes because they’re slightly ahead and they fear that after the recounting they won’t be.” Senator Bob Graham (D-FL) later agrees with Lieberman, saying that if necessary, every single vote in Florida should be manually recounted. “What we’re trying to achieve here is an election that has credibility by the American people. That credibility would likely be enhanced if all Florida voters had their ballots hand counted,” he says. However, Bush campaign lawyers say such a move would unfairly “keep the state and the nation on hold.” (Guardian 11/20/2000)
Miami-Dade County election officials vote unanimously to halt the county’s manual recount of presidential ballots (see November 7, 2000 and Before 10:00 a.m. November 19, 2000), saying the county does not have enough time to complete its recount by the November 26 deadline. Instead, they vote to recount only 10,750 “undervotes,” ballots that don’t clearly indicate a presidential choice. The decision costs Democratic candidate Al Gore a 157-vote gain from the halted recount process. That evening, a Florida State appeals court denies a motion by Democrats to force Miami-Dade County to restart the manual recount. (Whitman et al. 12/13/2000; Pittsburgh Post-Gazette 12/17/2000; Leip 2008)
Opposing Beliefs - The next day, the Florida Supreme Court will also refuse to order Miami-Dade to restart the recount (see 2:45 p.m. November 23, 2000). Press reports say that the decision “dramatically reverse[s] the chances of Al Gore gathering enough votes to defeat George W. Bush.” Gore’s senior campaign advisor William Daley calls the recounts “mandatory” and calls for “the rule of law” to be upheld. For his part, Bush says: “I believe Secretary Cheney and I won the vote in Florida (see After 3:30 a.m. November 8, 2000). And I believe some are determined to keep counting in an effort to change the legitimate result.” In light of the Miami-Dade decision, the Bush campaign’s chief legal advisor James Baker invites the Republican-controlled Florida Legislature to unilaterally declare Bush the victor, saying, “One should not now be surprised if the Florida legislature seeks to affirm the original rules.”
Agitators Disrupt Recount Proceedings - The recount proceedings are disrupted and ultimately ended by a mob of Republicans, some local and some bussed and flown in from Washington by the Bush campaign. The agitators are protesting outside the Miami-Dade County election offices, shouting and attempting to interfere with the proceedings of the canvassing board. Rioters Made Up of Republican Staffers, Others - Democrats accuse Republican protesters of intimidating the Miami-Dade County officials into stopping the recount. Democratic vice-presidential candidate Joe Lieberman says the demonstrations in Miami have been orchestrated by Republicans “to intimidate and to prevent a simple count of votes from going forward.” Six Democratic members of the US Congress demand the Justice Department investigate the claims, saying that civil rights have been violated in “a shocking case of undermining the right to vote through intimidation and threats of violence.” Jenny Backus, a spokeswoman for the Democratic National Committee (DNC), says, “The Republicans are out of control,” and accuses them of using paid agitators to “create mob rule in Miami.” (Guardian 11/25/2000) Later investigations show that the “spontaneous protests” by Republican protesters were far more orchestrated and violent than generally reported by the press at the time. Investigative journalist Robert Parry will write that the protests, called the “Brooks Brothers Riot” because of the wealthy, “preppie” makeup of the “protesters,” helped stop the recount, “and showed how far Bush’s supporters were ready to go to put their man in the White House.” He will write that the protests should be more accurately termed a riot. At least six of the rioters were paid by the Bush recount committee, payments documented in Bush committee records only released to the IRS in July 2002 (see July 15, 2002). Twelve Republican staffers will later be identified in photographs of the rioters. The six who can be confirmed as being paid are: Bush staffer Matt Schlapp from Austin, Texas; Thomas Pyle, a staff aide to House Majority Whip Tom DeLay (R-TX); DeLay fundraiser Michael Murphy; Garry Malphrus, House majority chief counsel to the House Judiciary Subcommittee on Criminal Justice; Charles Royal, a legislative aide to Representative Jim DeMint (R-SC); and former Republican House staffer Kevin Smith. Another Republican is identified as Doug Heye, a staffer for Representative Richard Pombo (R-CA). At least three of the rioters—Schlapp, Malphrus, and Joel Kaplan—will later join the Bush White House. Many of the rioters were brought in on planes and buses from Washington as early as mid-November, with promises of expenses payments. On November 18, 2000, the Bush campaign told activists, “We now need to send reinforcements” to rush to Florida. “The campaign will pay airfare and hotel expenses for people willing to go.” Many of the respondents are low-level Republican staffers from Congress. “These reinforcements… added an angrier tone to the dueling street protests already underway between supporters of Bush and Gore,” Parry will write. Quoting ABC reporter Jake Tapper, Parry will write, “The new wave of Republican activists injected ‘venom and volatility into an already edgy situation.’” Signifying the tone, before the Miami riot, Brad Blakeman, Bush’s campaign director of advance travel logistics, screamed down a CNN correspondent attempting to interview a Democratic Congressman: “This is the new Republican Party, sir! We’re not going to take it anymore!” (Consortium News 11/27/2000; Parry 8/5/2002; Margolick, Peretz, and Shnayerson 10/2004) Some of the local protesters are summoned to the Miami-Dade electoral offices by angry broadcasts over radio stations with largely Cuban-American audiences; over these radio stations, listeners hear Bush campaign lawyer Roger Stone, coordinating the radio response, say that the recounts intend to disenfranchise Hispanic voters. Republican operatives coordinate the protests by shouting orders through megaphones. Details of the Riot; Staffers Assaulted and Beaten - After learning that the Miami-Dade County canvassing board was beginning to examine 10,750 disputed ballots that had not previously been counted, US Representative John Sweeney (R-NY) issues the order to “Shut it down!” (Sweeney is coordinating his efforts with a local Cuban congressman who himself is coordinating the Cuban-American mob response.) Brendan Quinn, the executive director of the New York Republican Party, tells some two dozen Republican operatives outside the Miami-Dade County election offices to storm the room on the 19th floor where the canvassing board is meeting. Tapper later writes: “Emotional and angry, they immediately make their way outside the larger room in which the tabulating room is contained. The mass of ‘angry voters’ on the 19th floor swells to maybe 80 people,” including many of the Republican activists from outside Florida, and joined by local protesters. As news organizations videotape the scene, the protesters reach the board offices and begin shouting slogans such as “Stop the count! Stop the fraud!” “Three Blind Mice!” and “Fraud, fraud, fraud!” and banging on doors and walls. The protesters also shout that a thousand potentially violent Cuban-Americans are on the way. Official observers and reporters are unable to force their way through the shouting crowd of Republican operatives and their cohorts. Miami-Dade spokesman Mayco Villafena is physically assaulted, being pushed and shoved by an unknown number of assailants. Security officials, badly outmanned, fear the confrontation will swell into a full-scale riot. Miami-Dade elections supervisor David Leahy orders the recounts stopped, saying, “Until the demonstration stops, nobody can do anything.” (Although board members will later insist that they were not intimidated into stopping, the recounts will never begin again. Leahy will later say: “This was perceived as not being an open and fair process. That weighed heavy on our minds.”) Meanwhile, unaware of the rioting, county Democratic chairman Joe Geller stops at another office in search of a sample ballot. He wants to prove his theory that some voters had intended to vote for Gore, but instead marked an adjoining number indicating no choice. He finds one and leaves the office. Some of the rioters spot Geller with the sample ballot, and one shouts, “This guy’s got a ballot!” Tapper will later write: “The masses swarm around him, yelling, getting in his face, pushing him, grabbing him. ‘Arrest him!’ they cry. ‘Arrest him!’ With the help of a diminutive DNC [Democratic National Committee] aide, Luis Rosero, and the political director of the Miami Gore campaign, Joe Fraga, Geller manages to wrench himself into the elevator.” Rosero stays behind to attempt to talk with a reporter, and instead is kicked and punched by rioters. A woman shoves Rosero into a much larger man in what Tapper will later theorize was an attempt to start a fight between Rosero and the other person. In the building lobby, some 50 Republican protesters and activists swarm Geller, surrounding him. Police escort Geller back to the 19th floor in both an attempt to save him from harm and to ascertain what is happening. The crowd attempts to pull Geller away from the police. Some of the protesters even accost 73-year-old Representative Carrie Meek (D-FL). Democratic operatives decide to leave the area completely. When the mob learns that the recounts have been terminated, they break forth in lusty cheers.
After-Party - After the riots, the Bush campaign pays $35,501.52 for a celebration at Fort Lauderdale’s Hyatt Regency, where the rioters and campaign officials party, enjoy free food and drink, receive congratulatory calls from Bush and Dick Cheney, and are serenaded by Las Vegas crooner Wayne Newton, singing “Danke Schoen,” German for “thank you very much.” Other expenses at the party include lighting, sound system, and even costumes.
Media Reportage - Bush and his campaign officials say little publicly about the riot. Some press outlets report the details behind the riots. The Washington Post later reports that “even as the Bush campaign and the Republicans portray themselves as above the fray,” national Republicans actually had joined in and helped finance the riot. The Wall Street Journal tells readers that Bush offered personal words of encouragement to the rioters after the melee, writing, “The night’s highlight was a conference call from Mr. Bush and running mate Dick Cheney, which included joking reference by both running mates to the incident in Miami, two [Republican] staffers in attendance say.” The Journal also observes that the riot was led by national Republican operatives “on all expense-paid trips, courtesy of the Bush campaign.” And, the Journal will note, the rioters went on to attempt to disrupt the recounts in Broward County, but failed there to stop the proceedings. The Journal will write that “behind the rowdy rallies in South Florida this past weekend was a well-organized effort by Republican operatives to entice supporters to South Florida,” with DeLay’s Capitol Hill office taking charge of the recruitment. No similar effort was made by the Gore campaign, the Journal will note: “This has allowed the Republicans to quickly gain the upper hand, protest-wise.” And the Journal will write that the Bush campaign worked to keep its distance from the riots: “Staffers who joined the effort say there has been an air of mystery to the operation. ‘To tell you the truth, nobody knows who is calling the shots,’ says one aide. Many nights, often very late, a memo is slipped underneath the hotel-room doors outlining coming events.” But soon, media reports begin echoing Bush campaign talking points, which call the “protests” “fitting, proper,” and the fault of the canvassing board: “The board made a series of bad decisions and the reaction to it was inevitable and well justified.” The Bush campaign says the mob attack on the elections office was justified because civil rights leader Jesse Jackson had led peaceful, non-violent protests in favor of the recounts in Miami the day before. The campaign also insists that the protests were spontaneous and made up entirely of local citizens. On November 26, Governor Marc Racicot (R-MT), a Bush campaign spokesman, will tell NBC viewers: “Clearly there are Americans on both sides of these issues reflecting very strong viewpoints. But to suggest that somehow this was a threatening situation, in my view, is hyperbolic rhetoric.”
Effect of the Riot - According to Parry, the riot, broadcast live on CNN and other networks, “marked a turning point in the recount battle. At the time, Bush clung to a lead that had dwindled to several hundred votes and Gore was pressing for recounts (see November 20-21, 2000). The riot in Miami and the prospects of spreading violence were among the arguments later cited by defenders of the 5-to-4 US Supreme Court ruling (see 9:54 p.m. December 12, 2000)… that stopped a statewide Florida recount and handed Bush the presidency. Backed by the $13.8 million war chest, the Bush operation made clear in Miami and in other protests that it was ready to kick up plenty of political dust if it didn’t get its way.” In the hours after the riot, conservative pundits led by Rush Limbaugh will engage in orchestrated assaults on the recount process as fraudulent and an attempt by the Gore campaign to “invent” votes. No one is ever charged with any criminal behaviors as a result of the riot. The Bush campaign works with Florida Republicans to orchestrate the so-called “Sore Loserman” campaign, playing off the names of the two Democratic presidential ticket members, Al Gore (D-TN) and Joe Lieberman (D-CT), to bring pressure for the Democrats to concede the presidency to George W. Bush. Throughout the day, Republican activists protest and wave “Sore Loserman” signs outside the canvassing board offices in the Florida counties that are still recounting votes. One Gore ally is physically threatened by protesters outside the Broward County courthouse and requires bodyguards to exit the courthouse unscathed. Democrats charge that the protesters are trying to disrupt the recount effort (see 9:00 a.m. and after, November 22, 2000) and send a letter to the US Justice Department asking for an immediate investigation. (Whitman et al. 12/13/2000) A few days later, Steven Meyer, a Democratic election observer in Palm Beach County, writes that both Republicans and Democrats are busing in protesters, but Republicans are paying protesters to participate. “I doubt that the people on the Democratic side are getting paid because we don’t have the cash,” he notes. Democrats who “infiltrate” the Republican protests will report being offered pay and expense money to keep coming back. He also writes: “Now, it’s reported that many of these protesters are the same people whom Cuban groups paid to stand outside of Elian Gonzalez’s home in Little Havana. It’s a regular cottage industry—have sign and clever slogan, will travel.” (Meyer 12/14/2000) Gonzalez is a young Cuban-American boy who became a cause celebre for some conservatives who accused the Clinton administration of enabling his Cuban father to “kidnap” him and return with him to Cuba after his mother died. (Haberman 1/14/2000)
Florida Secretary of State Katherine Harris, the co-chair of Florida’s Bush campaign team (see After 3:30 a.m. November 8, 2000 and After), certifies George W. Bush (R-TX) the winner of Florida’s presidential election, though according to a Florida Supreme Court ruling she can choose to accept recount tallies through November 27 (see November 20-21, 2000). She chooses not to do so. Harris says Bush has a 537-vote lead. Her totals are: Bush, 2,912,790; Vice President Al Gore (D-TN), 2,912,253. The totals include none of the recounted ballots from either Palm Beach or Miami-Date Counties, both of which did not complete their recounts by Harris’s deadline (see 9:00 a.m. and after, November 22, 2000 and 2:45 p.m. November 26, 2000). Ongoing legal actions by both parties keep the election in doubt. Regardless, Governor Jeb Bush, George W. Bush’s brother, signs the Certificate of Ascertainment designating 25 Florida electors pledged to George W. Bush and transmits the document to the National Archives as required by Title 3, US Code, Section 6. Three days later, a Florida legislative committee will recommend a special session to name the state’s 25 representatives to the Electoral College, where they will presumably cast their votes for Bush. (Whitman et al. 12/13/2000; Pittsburgh Post-Gazette 12/17/2000; Leip 2008) If Bush is indeed the winner of the Florida presidential election, he has enough electoral votes to assume the presidency (see November 9, 2000). The Gore campaign refuses to accept Harris’s certification, and says it will ask Florida courts to order recounts of thousands of disputed votes. Gore’s running mate Joe Lieberman says, “This evening, the secretary of state of Florida has decided to certify what—by any reasonable standard—is an incomplete and inaccurate count of the votes cast in the state of Florida.” The Gore campaign is working out details of what will be a formal “contest” of the results, and will ask a state judge to order court-appointed “special masters” to complete interrupted recounts of about 2,000 uncounted votes in Palm Beach County and 10,700 uncounted votes in Miami-Dade County. They also want an inquiry into the Nassau County returns, where Gore officials believe Bush was wrongly credited with some 51 votes, and are considering challenging the legality of Palm Beach’s controversial “butterfly ballots.” Gore’s chief lawyer David Boies says: “We’re preparing contest papers that will be filed Monday, as early in the day as we can get them done. Until these votes are counted, this election cannot be over.” Republicans intend to use Harris’s ruling to publicly pressure Gore into conceding the election, pressure the Gore campaign says it is prepared to combat. Miami-Dade County, expected to yield enough votes in a recount to swing the election in favor of Gore, called off its recount under pressure from Republican protesters and due to time constraints (see 9:00 a.m. and after, November 22, 2000). (Salon 11/25/2000; Kettle and Campbell 11/27/2000; Kettle 11/28/2000) Investigative reporter Robert Parry will later write that Harris deliberately allowed Nassau County to throw out its recounted figures that gave Gore the 51 votes. (Parry 8/5/2002) A brief furor ensues when some media outlets mistakenly report that 500 absentee ballots “not previously counted” were discovered in Broward County. The story is not true. (Salon 11/25/2000) According to state law, it is only now that Gore can ask for a statewide recount. (Margolick, Peretz, and Shnayerson 10/2004) Former President Jimmy Carter tells a reporter: “More than two weeks will remain before Florida’s 25 electors will have to be named, and then two more months before a new president will be sworn into office. We must not sacrifice speed for accuracy in deciding who has been chosen by the voters to take that oath.” (Salon 11/25/2000)
Democratic Congressional leaders Senator Tom Daschle (D-SD) and Representative Richard Gephardt (D-MO) hold a televised conference call with Vice President Al Gore and his running mate, Senator Joe Lieberman (D-CT), in a show of support for the Gore campaign efforts to stop Florida from certifying George W. Bush as the winner of the state presidential race (see 7:30 p.m. November 26, 2000). “What we’re talking about involves many thousands of votes that have never been counted at all,” Gore tells Daschle and Gephardt. (Kettle 11/28/2000; Whitman et al. 12/13/2000)
A Republican-dominated panel in the Florida Legislature votes to recommend convening a special session of the legislature (see 1:00 p.m. November 28, 2000) to designate the state’s 25 electors and send them to Washington to cast the state’s ballots for George W. Bush even if the election is not resolved by December 12, when all states are to officially certify a winner of their presidential contests. The previous day, Florida Governor Jeb Bush, the brother of George W. Bush, said it would be an “act of courage” for the legislature to call a special session “if it was the appropriate thing to do.” The legality of designating electors in such a fashion is questionable; Democratic vice-presidential candidate Senator Joe Lieberman says such a decision “threatens to put us into a constitutional crisis.” Shortly after Lieberman’s comments, candidate Bush meets with reporters outside his Crawford, Texas, ranch, flanked by vice-presidential candidate Dick Cheney and putative Bush Secretary of State designate General Colin Powell. Bush says, “One of our strategies is to get this election ratified, and the sooner the better for the good of the country.” (Whitman et al. 12/13/2000; Guardian 11/30/2008)
Vice President Al Gore is out of options after the US Supreme Court halted all Florida recounts (see 9:54 p.m. December 12, 2000). He orders his Florida recount committee to suspend its activities. At 9:00 p.m., Gore, accompanied by his wife Tipper, his vice-presidential running mate Joe Lieberman, and Lieberman’s wife Hadassah, gives a nationally broadcast speech. He tells the nation he accepts George W. Bush as the legitimate 43rd president of the United States. “This is America, and we put country before party,” he tells viewers. For his part, Bush pledges to deliver reconciliation and unity to a divided nation in his acceptance speech, saying “our nation must rise above a house divided.” However, Bush immediately indicates that he will seek to reform Social Security and Medicare, two issues guaranteed to cause division among Americans. (Whitman et al. 12/13/2000; Pittsburgh Post-Gazette 12/17/2000; Leip 2008)
The US House Committee on Energy and Commerce holds a hearing on the news networks’ election night decision to project George W. Bush the winner of the Florida election, and thereby the winner of the US presidential election (see November 7-8, 2000). One of the matters at hand is Fox News’s choice to have its election night coverage anchored by John Prescott Ellis, President Bush’s cousin and an intensely partisan Bush supporter (see October-November 2000). The chairman of the committee is W.J. “Billy” Tauzin (R-LA).
Opening Statements - In his opening statement, Tauzin tells the assemblage that the hearing is to “give us a real sense of what went wrong in terms of the election night coverage of the presidential election of November 2000.” He notes that news coverage issues have been raised in every election since the 1960 Kennedy-Nixon election. Early calls—the practice of news outlets to “call,” or project, winners in states before elections in other states have closed—have long been acknowledged as having a “deletorious” effect on voting, and the use of “exit polling”—polls of voters taken outside polling booths—have proven both “valuable” and “dangerous.” Voter News Service (VNS), the independent consortium that provided polling and other data to the networks and press agencies for their use during their election coverage, uses exit polling to help those news outlets “project” winners in races. Tauzin spends much of his opening statement attacking VNS and the use of exit polling as the “source” of the election night dissension, and says that on the whole, VNS data “produces statistical biases in favor of Democrats in this case today and against Republicans, that the statistical flaws tend to overstate the Democratic vote in the exit poll and understate the Republican vote.” Tauzin says that investigations have “discovered no evidence of intentional bias, no evidence of intentional slanting of this information,” and instead says the entire problem rests with VNS and its use of exit polling data. In their opening statements, many Republicans echo Tauzin’s remarks. Ranking minority member John Dingell (D-MI) calls the election night coverage “a monumental screw-up which I think has embarrassed an awful lot of people.” Dingell repeats Tauzin’s claim that no evidence of intentional bias has been found—calling such allegations “inflammatory”—and says that the focus of future hearings should be on the issue of voter disenfranchisement. Having said all that, he goes on to say that the networks’ decision to call Florida for Bush in the early hours of November 8, 2000 was premature, and lent itself to later allegations that attempts by Democratic challenger Al Gore were baseless and troublesome. Cliff Stearns (R-FL) accuses the networks of trying to influence Florida voters in the Panhandle, a traditionally Republican stronghold, by prematurely calling the state for Gore eight minutes before polls closed in that region. In questioning, Sherrod Brown (D-OH) notes the almost-immediate appearance of the “Sore Loserman” campaign (derived from the names of the Democratic candidates, Gore and Joe Lieberman), which attempted, successfully, to paint attempts by the Gore campaign to force vote recounts as attempts to “steal” the election.
Focus on Fox - Henry Waxman (D-CA) is the first to mention Fox News. He reads from a Los Angeles Times editorial, quoting: “Suppose that a first cousin of Al Gore had been running one of the network news teams issuing election night projections. Suppose that having previously recused himself from a columnist job saying his objectivity would suffer from family loyalty, this cousin had chatted with Gore six times on Election Day. Suppose the same cousin had been the first to declare Gore as the winner in Florida on election night, helping coax the rival networks to follow suit, leading George W. Bush to call up Gore in order to concede, thereby helping to create that Gore was the duly elected president of the United States long before all the votes had been counted. Can anybody reasonably doubt that the pundits would be working themselves into a nonstop lather charging the liberal media as accessories to grand larceny? Can we imagine, say, Rupert Murdoch’s Fox news channel right-leaning heads dropping the subject?” Waxman says this was absolutely the case, but with Fox News and John Ellis, not Gore and an imaginary Gore cousin at another network. “[O]f everything that happened on election night this was the most important in impact. It created a presumption that George Bush won the election. It set in motion a chain of events that were devastating to Al Gore’s chances and it immeasurably helped George Bush maintain the idea in people’s minds than he was the man who won the election.” Several other Democrats echo Waxman’s statements.
Issues with Florida Election Practices - Peter Deutsch (D-FL) cites issues of rampant voter disenfranchisement of African-Americans, a traditionally Democratic voting bloc, with over 100,000 ballots, mostly from African-American voters, apparently not counted. Deutsch says flatly that “there is no question, it is no longer debatable that if the vote in Florida were counted, Al Gore would be president of the United States.” Bobby Rush (D-IL) cites a large number of incidents where minority group voters were “harassed by police departments” in Florida and in other states besides. In many instances these voters were stopped from voting entirely; in others, their votes were not counted. Other Democrats, such as Eliot Engel (D-NY), echo Deutsch’s and Rush’s concerns; Engel says: “Al Gore was not the only one who lost that night. The American people lost that night, and the news media also lost that night.”
Testimony regarding Independent Review of Election Night Coverage - The first witness is Joan Konner, a professor of journalism at Columbia. Konner led a panel commissioned by CNN “to look at what went wrong in [CNN’s] television coverage of the presidential election 2000.” Her panel submitted a report on the election night coverage to CNN, and CNN provided that report to the committee. “[S]omething went terribly wrong,” she says. “CNN executives, correspondents, and producers themselves describe election night coverage as a debacle, a disaster, and a fiasco; and in our report we agree.” She blames the problems with CNN’s coverage on “excessive speed and hypercompetition, combined with overconfidence in experts and a reliance on increasingly dubious polls. We have stated that the desire to be first or at least not to be consistently behind the others led the networks to make calls unwisely based on sketchy and sometimes mistaken information.” The choice to create, fund, and use VNS by all the networks was primarily a cost-cutting decision, she says, but that choice was a mistake: “Relying on a single source eliminates the checks and balances built into a competitive vote-gathering and vote system. It eliminates the possibility of a second source for validating key and possible conflicting information.” Another member of the panel, James Risser of Stanford University, notes that the report’s findings apply equally to other networks along with CNN.
Media Panel - After much questioning of the CNN panel, a second panel is sworn in. This panel includes: Fox News chairman Roger Ailes; CBS president Andrew Heyward; CNN chairman Tom Johnson; NBC president Andrew Lack; ABC president David Westin; VNS director Ted Savaglio; VNS editorial director Murray Edelman; and the Associated Press’s president, Louis Boccardi. In an opening statement, Savaglio admits that VNS made “errors” in vote tabulation and predictives based on “flaws” in the statistical analyses. Two major errors were made on election night, Savaglio says, the first leading to the incorrect awarding of Florida to Gore early in the evening, and the second provision of data that indicated Bush had a statistically insurmountable lead in Florida that did not include an accurate tabulation of votes cast in Volusia County as well as errors in other county tabulations and estimates. Boccardi says that the Associated Press used VNS-provided data in the erroneous Gore projection, but “takes full responsibility” for the error. The Associated Press did not join in with the second, Fox News-led projection of Bush’s victory. “[T]he race was too close to call” at that point, he says. “It would be right to surmise that the pressure on AP at that moment [to join the networks in calling the election for Bush] was enormous.” Heyward testifies that CBS, like CNN, hired an independent panel to assess its election coverage, and has a number of improvements to be made for future coverage. “Our method of projecting winners, one that, as you have heard, has produced only six bad calls in over 2,000 races since the 1960s, failed us this time; and as a well-known candidate would say, failed us big time in the very state that held the key to this election,” he says. He also notes that charges by Republican committee members that there is an inherent bias in the statistical models against Republicans “has been rejected by every single outside expert who examined each of the networks, even those experts, and you heard from them today, who are the most highly critical of us.” Lack asks why there was not more media coverage and examination of other voting-related problems, from “ineffective voting machines” and “confusing ballots” to allowing felons to vote.
Ailes's Statement - Ailes blames VNS for Fox’s “mistakes” in its reporting, saying: “As everyone knows, Voter News Service, a consortium with a good track record, gave out bad numbers that night. In the closest race in history the wheels apparently came off a rattle trap computer system which we relied on and paid millions for.” He claims, “Through our self-examination and investigation we have determined that there was no intentional political favoritism in play on election night on the part of Fox News.” Ailes does not mention his choice to use Ellis as Fox’s election night anchor in his verbal statement, but in a written statement he submits to the committee, he says that Ellis was not the person who made the final decision to declare Florida for Bush. The news division’s vice president, John Moody, made the final call. As for hiring Ellis, he praises Ellis’s professionalism and experience, and writes: “We at Fox News do not discriminate against people because of their family connections. I am more than happy to give you examples of offspring of famous politicians who are employed at Fox News.” He also says that he was aware that Ellis was speaking to both George W. and Jeb Bush throughout the night, and writes: “Obviously, through his family connections, Mr. Ellis has very good sources. I do not see this as a fault or shortcoming of Mr. Ellis. Quite the contrary, I see this as a good journalist talking to his very high level sources on election night.” Though Ellis has freely admitted to sharing VNS data with both Bushes, Ailes writes, “Our investigation of election night 2000 found not one shred of evidence that Mr. Ellis revealed information to either or both of the Bush brothers which he should not have, or that he acted improperly or broke any rules or policies of either Fox News or VNS.” He concludes: “[I]n my heart I do believe that democracy was harmed by my network and others on November 7, 2000. I do believe that the great profession of journalism took many steps backward.”
Questioning the Media Representatives - Almost immediately, Ailes raises the question of skewed exit polling that appears to favor Democrats, though experts have refuted these claims in just-given testimony, and Savaglio has just said that exit polls exhibit no such bias. Ailes tells the panel: “I do know that when Republicans come out of polls and you ask them a question they tend to think it’s none of your business and Democrats want to share their feelings. So you may get some bias there that is inadvertent, just because it’s a cultural thing and unless you send the Republicans to sensitivity training you’re not going to get them to do that.” Tauzin says that a study of VNS results tends to bear out Ailes’s claim. Westin says if there is bias in exit polling, it cuts both ways, an observation with which Tauzin also agrees. Savaglio admits that after midnight, VNS provided substantially inaccurate information to the networks that led them to conclude Bush had a slight but insurmountable lead in Florida. Lack denies the rumor that Jack Welch, the CEO of NBC’s parent company General Electric, made the decision for NBC News to follow Fox’s lead in declaring Bush the presumptive winner in Florida. Waxman accepts Lack’s denial, but notes that he has been told Welch’s command to declare Bush the winner is preserved on videotape, “filmed by NBC’s advertising and promotions department.” Lack says if the tape exists, he will provide it to the committee. Bart Stupak (D-MI) asks the representatives directly if they believe any bias towards one party or another exists in their networks’ coverage, and all answer strongly in the negative. Heyward says that rumors of networks such as his trying to “slant” their coverage to give the idea of an “inevitable” Gore victory are entirely negative, and says: “[C]ertainly we displayed the popular vote graphic 15 times between 7 and 11. President Bush was ahead every single time; on the electoral count, 75 out of 100 times.… The video [shown by the commission at the beginning of the hearing] that gave the impression that the networks were saying Gore’s got it in the bag I believe was misleading, yes.” Westin agrees with Heyward, and says the networks generally gave the impression of “a much more balanced, much closer race throughout the night.” Under questioning by Gene Green (D-TX), Ailes contradicts previously presented evidence and says no one at the election desk, Ellis or anyone else, was in contact with “Austin” (meaning the Bush campaign and George W. Senator Dianne Feinstein (D-CA) calls for the Senate Committee on Governmental Affairs to hold hearings on a possible improper relationship between Enron and the Federal Energy Regulatory Commission (FERC). Her call for an investigation is prompted by media reports of Enron CEO Kenneth Lay pressuring FERC chairman Curtis Hebert to deregulate the energy industry in ways favorable to Enron (see August 14, 2001). Feinstein writes to Senator Joseph Lieberman (D-CT), the ranking member of the committee, “Despite evidence of manipulation and price gouging in both the electricity and natural gas markets in California and the West, and a finding by FERC last November of ‘unjust and unreasonable’ rates, the commission has failed to take the actions necessary to bring reliability and stability to the marketplace… [I]t is clear that the citizens of the United States, especially the people of California, who are suffering from FERC’s failure to do its job, deserve an investigation and full public hearing into what happened. FERC is a $175 million a year agency charged with regulating the energy industry, and it would be unconscionable if any of the nation’s electricity traders or generators were in a position to be able to determine who chairs or becomes a member of the commission.” Lay is accused of forcing Hebert from his position in favor of another, more Enron-friendly chairman, Pat Wood. Feinstein adds, “Since FERC has refused to fulfill its legally mandated function under the Federal Power Act to restore ‘just and reasonable’ electricity rates, we need to ask whether undue influence by the companies that FERC regulates has resulted in its failure to act… In California, the total cost of electricity in 1999 was $7 billion. This climbed to $28 billion in 2000 and is predicted to reach $70 billion this year. At the same time, with FERC refusing to act, power generators and marketers have made record profits. The people of our nation deserve a full investigation.” (US Senate 5/25/2001)
On NBC’s “Meet the Press,” Senator Joseph Lieberman (D-CT) says, “As long as Saddam Hussein is in power in Iraq, the United States is in danger.” He says there is evidence that “suggests Saddam Hussein may have had contact with bin Laden and the al-Qaeda network, perhaps [was] even involved in the September 11 attack.” He adds that an even more important factor is that Saddam “has worked on chemical and biological weapons and has used them against his own people and against the Iranians.” He concludes, “Therefore, in my opinion, Saddam is a terrorist—and it should be a centerpiece of our policy, after we’ve finished the business in Afghanistan and bin Laden, to end [the Iraqi] regime.” (Price 10/26/2001)
US Congressmen write a letter to President Bush urging him to take military action against Iraq. Among those who sign the letter are Jesse Helms (R-NC), Joseph Lieberman (D-CT), John McCain (R-AZ), Henry Hyde (R-IL), and Trent Lott (R-MS). The letter states, “As we work to clean up Afghanistan, it is imperative that we plan to eliminate the threat from Iraq. This December will mark three years since United Nations inspectors last visited Iraq. There is no doubt that since that time, Saddam Hussein has reinvigorated his weapons programs.… Reports indicate that biological, chemical and nuclear programs continue apace and may be back to pre-Gulf War levels. We believe we must directly confront Saddam, sooner rather than later.” (Kristol 12/6/2001; Jensen 12/15/2001)
Two bipartisan pairs of senators introduce legislation to create independent 9/11 commissions. Senators Joseph Lieberman (D-CT) and John McCain (R-AZ) propose to create a 14-member, bipartisan commission with subpoena power. At the same time, Robert Torricelli (D-NJ) and Charles Grassley (R-IN) propose to create a 12-member board of inquiry with subpoena power. White House spokeswoman Anne Womack is noncommittal about the proposals, saying, “We look forward to reviewing them. Right now, the president is focused on fighting the war on terrorism.” (Mitchell 12/21/2001)
While detailed plans for the upcoming invasion of Iraq are well underway, the administration realizes that the American people are not strongly behind such an invasion. They aren’t convinced that Saddam Hussein was responsible for the 9/11 attacks, and unsure about Iraq having weapons of mass destruction. White House and Pentagon officials decide that using retired military officers as “independent military analysts” in the national media can help change hearts and minds (see April 20, 2008). Assistant secretary of defense for public affairs Victoria “Torie” Clarke, a former public relations executive, intends to achieve what she calls “information dominance.” The news culture is saturated by “spin” and combating viewpoints; Clarke argues that opinions are most swayed by voices seen as authoritative and completely independent. Clarke has already put together a system within the Pentagon to recruit what she calls “key influentials,” powerful and influential people from all areas who, with the proper coaching, can generate support for Defense Secretary Donald Rumsfeld’s agenda. After 9/11, when each of the news networks rushed to land its own platoon of retired military officers to provide commentary and analysis, Clarke saw an opportunity: such military analysts are the ultimate “key influentials,” having tremendous authority and credibility with average Americans. They often get more airtime than network reporters, Clarke notes. More importantly, they are not just explaining military minutiae, but telling viewers how to interpret events. Best of all, while they are in the news media, they are not creatures of the media. Reporter David Barstow will write in 2008, “They were military men, many of them ideologically in sync with the administration’s neoconservative brain trust, many of them important players in a military industry anticipating large budget increases to pay for an Iraq war.” And even those without such ties tended to support the military and the government. Retired Army general and ABC analyst William Nash will say: “It is very hard for me to criticize the United States Army. It is my life.”
'Writing the Op-Ed' for the War - As a result, according to Clarke’s aide Don Meyer, Clarke decides to make the military analysts the main focus of the public relations push to build a case for invading Iraq. They, not journalists, will “be our primary vehicle to get information out,” Meyer recalls. The military analysts are not handled by the Pentagon’s regular press office, but are lavished with attention and “perks” in a separate office run by another aide to Clarke, Brent Krueger. According to Krueger, the military analysts will, in effect, be “writing the op-ed” for the war.
Working in Tandem with the White House - The Bush administration works closely with Clarke’s team from the outset. White House officials request lists of potential recruits for the team, and suggests names for the lists. Clarke’s team writes summaries of each potential analyst, describing their backgrounds, business and political affiliations, and their opinions on the war. Rumsfeld has the final say on who is on the team: “Rumsfeld ultimately cleared off on all invitees,” Krueger will say. Ultimately, the Pentagon recruits over 75 retired officers, though some only participate briefly or sporadically.
Saturation Coverage on Cable - The largest contingent of analysts is affiliated with Fox News, followed by NBC and CNN, the networks with 24-hour cable news coverage. Many analysts work for ABC and CBS as well. Many also appear on radio news and talk broadcasts, publish op-ed articles in newspapers, and are quoted in press reports, magazine articles, and in Web sites and blogs. Barstow, a New York Times reporter, will note that “[a]t least nine of them have written op-ed articles for The Times.”
Representing the Defense Industry - Many of the analysts have close ties with defense contractors and/or lobbying firms involved in helping contractors win military contracts from the Pentagon:
Retired Army general James Marks, who begins working as an analyst for CNN in 2004 (until his firing three years later—see July 2007) is a senior executive with McNeil Technologies, and helps that firm land military and intelligence contracts from the government.
Thomas McInerney, a retired Air Force general and Fox News analyst, sits on the boards of several military contractors.
CBS military analyst Jeffrey McCausland is a lobbyist for Buchanan Ingersoll & Rooney, a major lobbying firm where he is director of a national security team that represents several military contractors. His team proclaims on the firm’s Web site, “We offer clients access to key decision makers.”
Shortly after signing with CBS, retired Air Force general Joseph Ralston became vice chairman of the Cohen Group, a consulting firm headed by former Defense Secretary William Cohen (also an analyst for CNN). The Cohen Group says of itself on its Web site, “The Cohen Group knows that getting to ‘yes’ in the aerospace and defense market—whether in the United States or abroad—requires that companies have a thorough, up-to-date understanding of the thinking of government decision makers.”
Ideological Ties - Many military analysts have political and ideological ties to the Bush administration and its supporters. These include:
Two of NBC’s most familiar analysts, retired generals Barry McCaffrey and Wayne Downing, are on the advisory board of the Committee for the Liberation of Iraq, an advocacy group created with White House encouragement in 2002 to push for the overthrow of Saddam Hussein. (Barstow 4/20/2008) Additionally, McCaffrey is chief of BR McCaffrey Associates, which “provides strategic, analytic, and advocacy consulting services to businesses, non-profits, governments, and international organizations.” (Kurtz 4/21/2008) Other members include senators John McCain (R-AZ) and Joseph Lieberman (D-CT), and prominent neoconservatives Richard Perle and William Kristol. (Cohen 4/28/2008) Both McCaffrey and Downing head their own consulting firms and are board members of major defense contractors.
Retired Army general Paul Vallely, a Fox News analyst from 2001 through 2007, shares with the Bush national security team the belief that the reason the US lost in Vietnam was due to negative media coverage, and the commitment to prevent that happening with the Iraq war. In 1980, Vallely co-wrote a paper accusing the US press of failing to defend the nation from what he called “enemy” propaganda—negative media coverage—during the Vietnam War. “We lost the war—not because we were outfought, but because we were out Psyoped,” he wrote. Vallely advocated something he called “MindWar,” an all-out propaganda campaign by the government to convince US citizens of the need to support a future war effort. Vallely’s “MindWar” would use network TV and radio to “strengthen our national will to victory.” (Barstow 4/20/2008)
Ironically, Clarke herself will eventually leave the Pentagon and become a commentator for ABC News. (Goodman 4/22/2008)
Seducing the Analysts - Analysts describe a “powerfully seductive environment,” in Barstow’s words, created for them in the Pentagon: the uniformed escorts to Rumsfeld’s private conference room, lavish lunches served on the best government china, embossed name cards, “blizzard[s] of PowerPoints, the solicitations of advice and counsel, the appeals to duty and country, the warm thank you notes from the secretary himself.” Former NBC analyst Kenneth Allard, who has taught information warfare at the National Defense University, says: “[Y]ou have no idea. You’re back. They listen to you. They listen to what you say on TV.” Allard calls the entire process “psyops on steroids,” using flattery and proximity to gain the desired influence and effect. “It’s not like it’s, ‘We’ll pay you $500 to get our story out,’” Allard says. “It’s more subtle.”
Keeping Pentagon Connections Hidden - In return, the analysts are instructed not to quote their briefers directly or to mention their contacts with the Pentagon. The idea is always to present a facade of independent thought. One example is the analysts’ almost perfect recitation of Pentagon talking points during a fall and winter 2002 PR campaign (see Fall and Winter 2002). (Barstow 4/20/2008)
Senator Carl Levin (D-MI), the chairman of the investigations subcommittee of the Senate Governmental Affairs Committee, and fellow senators Byron Dorgan (D-ND), Ernest Hollings (D-SC), and Joseph Lieberman (D-CT) ask the General Accounting Office (GAO) to evaluate the process by which the Bush administration’s energy policy has been developed (see May 16, 2001). The senators’ request is apparently in support of the GAO’s long-blocked investigation of Vice President Cheney’s energy task force (see January 29, 2001). (General Accounting Office 8/25/2003 )
President Bush unveils a plan to reduce the “intensity” of greenhouse gases by 18 percent. Greenhouse gas intensity is the ratio of emissions to economic output, meaning that global warming pollution would continue to grow, but at a slower pace. This target would be achieved through $4.6 billion in tax credits and incentives, spent over a five-year period, to encourage businesses and farmers to cut their emissions. For example, the plan would provide tax credits to businesses that use renewable energy sources. (CNN 2/14/2006; Revkin 2/14/2006) Critics of the plan say a voluntary program based on tax credits and incentives represents a weak alternative to the Kyoto Protocol’s mandatory reductions which would cut emissions well below their 1990 levels by 2010. “We’ve found that these voluntary programs just don’t work,” says Joseph Lieberman. (CNN 2/14/2006) The New York Times notes, “The one thing the climate policy would not do is require anything of anybody.” (Revkin 2/14/2006) The president also introduces a second plan aimed at curbing air pollution. The “Clear Skies Initiative” would require reductions of sulfur dioxide emissions by 73 percent, nitrogen oxides by 67 percent, and mercury by 69 percent, by 2018. But the plan includes no reductions for carbon dioxide, the main greenhouse gas. Companies would be able to purchase credits from other businesses that have reduced their emissions below required levels. Unlike the plan supported by environmentalists and many Democrats, Bush’s program would delay these reductions until 2010 or later. (CNN 2/14/2006; Revkin 2/14/2006)
Newsweek reports that hijackers Nawaf Alhazmi and Khalid Almihdhar may have received money from Saudi Arabia’s royal family through two Saudis, Omar al-Bayoumi and Osama Basnan. Newsweek bases its report on information leaked from the 9/11 Congressional Inquiry in October. (Isikoff 11/22/2002; Isikoff 11/22/2002; Johnston and Risen 11/23/2002; Farah 11/23/2003) Al-Bayoumi is in Saudi Arabia by this time. Basnan was deported to Saudi Arabia just five days earlier. Saudi officials and Princess Haifa immediately deny any connections to Islamic militants. (Serrano, McManus, and Krikorian 11/24/2002) Newsweek reports that while the money trail “could be perfectly innocent… it is nonetheless intriguing—and could ultimately expose the Saudi government to some of the blame for 9/11…” (Isikoff 11/22/2002) Some Saudi newspapers, which usually reflect government thinking, claim the leak is blackmail to pressure Saudi Arabia into supporting war with Iraq. (MSNBC 11/27/2002) Senior US government officials claim the FBI and CIA failed to aggressively pursue leads that might have linked the two hijackers to Saudi Arabia. This causes a bitter dispute between FBI and CIA officials and the intelligence panel investigating the 9/11 attacks. (Johnston and Risen 11/23/2002) A number of senators, including Richard Shelby (R-AL), John McCain (R-AZ), Mitch McConnell (R-KY), Joseph Lieberman (D-CT), Bob Graham (D-FL), Joseph Biden (D-DE), and Charles Schumer (D-NY), express concern about the Bush administration’s action (or non-action) regarding the Saudi royal family and its possible role in funding Islamic militants. (Reuters 11/24/2002; Johnston and Shenon 11/25/2002) Lieberman says, “I think it’s time for the president to blow the whistle and remember what he said after September 11—you’re either with us or you’re with the al-Qaeda.” (ABC News 11/25/2002) FBI officials strongly deny any deliberate connection between these two men and the Saudi government or the hijackers (Shannon, Zagorin, and Duffy 11/24/2002) , but later even more connections between them and both entities are revealed. EPA staffers are instructed by higher-ups not to analyze any mercury or carbon dioxide reduction proposals that conflict with the president’s “Clear Skies” bill or, if they do, to keep the results under wraps. For example, an alternative proposal sponsored by senators Thomas R. Carper and Lincoln Chaffee is analyzed by the EPA but its conclusions—showing that the Carper-Chaffee plan has some advantages over Clear Skies—are not released. According to one EPA staffer later interviewed by the New York Times, Jeffrey Holmstead, the assistant administrator for air programs, wondered out loud during a May 2 meeting, “How can we justify Clear Skies if this gets out?” And in June, EPA administrator Christie Whitman sends a letter to senators John McCain and Joseph Lieberman, informing them that the EPA will not do economic analysis on their alternative plan to reduce carbon dioxide emissions as they requested. Senator McCain later tells the New York Times that he did “not feel it was normal procedure to refuse to analyze a bill that is under the agency’s jurisdiction.” (Lee 7/14/2003)
The Republican leadership of the Texas legislature sends agents from the Department of Homeland Security (DHS), the Texas Rangers, state troopers, and members of the Special Crimes unit to locate and apprehend over 50 Democratic state legislators who have left the state to prevent a quorum from being reached. The state Democrats left Austin, and the state, in order to prevent the Republican leadership from passing a controversial electoral redistricting plan that they say discriminates against minority voters (see 2002-2004). One Democratic lawmaker, Representative Helen Giddings, is apprehended. Many of the Democrats are staying for the time being in Ardmore, Oklahoma. One Democrat, Representative Craig Eiland, says that police officers questioned his wife in Galveston, where their newborn twins are in intensive care. He calls the law enforcement efforts to “find” him and his colleagues “bordering on harassment,” and advises, “Let the good guys go back to catching the bad guys and let the politicians deal with each other.” Under Texas law, even though the Democrats are committing no crime in refusing to participate in the legislative session, state law enforcement officers have the authority to arrest members of the legislature and forcibly return them to Austin to allow the legislature to achieve a quorum. Use of Federal Resources; DHS 'Furious' at Involvement - US Representative Tom DeLay (R-TX) says that the Speaker of the Texas House, Tom Craddick (R-Midland), has asked for the intervention of the FBI and/or US Marshals to “go up and get those members.” Craddick denies making any such request. The US attorney’s office in San Antonio says that an “unidentified person” called it with an inquiry about federalizing the “arrest warrant.” A Justice Department spokesperson says the issue is entirely a state matter, and “would not warrant investigation by federal authorities.” The Air and Marine Interdiction and Coordination Center, a federal agency under the purview of the DHS, is involved for a time in a search for a private plane belonging to former House Speaker Pete Laney (D-Hale Center). The agency’s purpose is to engage in counterterrorism activities. Craddick says that the agency was successful in locating the airplane in Ardmore, alerting him that many of the Democrats are in that town. Craddick says: “We called someone, and they said they were going to track it. I have no idea how they tracked it down. That’s how we found them.” Bush administration officials promised that DHS agencies and officials would not operate within American borders when the agency was created. (Root 5/14/2003; Smith 5/14/2003) According to DHS officials, someone in the Texas Department of Public Safety (DPS) calls the Air and Marine Interdiction Coordination Center on May 12 and says: “We got a problem and I hope you can help me out. We had a plane that was supposed to be going from Ardmore, Oklahoma, to Georgetown, Texas. It has state representatives in it and we cannot find this plane.” The center agrees to help, DHS says, because “from all indications, this request from the Texas DPS was an urgent plea for assistance from a law enforcement agency trying to locate a missing, lost, or possibly crashed aircraft.” DHS officials contradict Craddick by denying that the center found Laney’s plane in Ardmore. Senator Joseph Lieberman (D-CT) says: “I am outraged that Homeland Security resources are being used to help settle partisan scores. It’s inconceivable that anyone would waste scarce department resources for such an indefensible purpose.” Lieberman is demanding an investigation into the matter. Representative Jim Turner (D-TX), the ranking Democrat on the House Select Committee on Homeland Security, says he is reminded “of the days of Watergate, when federal resources were used for purely partisan political purposes.” According to the New York Times, DeLay is working closely with Craddick on the matter, though a DeLay spokesman denies that anyone from DeLay’s office has had any contact with DHS, and adds, “This is a smoke screen from the Democrats, who will say or do anything to change the subject from shirking their constitutional responsibilities.” DPS spokesperson Tom Vinger refuses to say specifically what his department has done to find the legislators, saying only: “We were ordered to begin an investigation into the missing legislators by the Texas House and to take them into custody if we found them and bring them back to the House chambers. Those were our orders. And we used very basic, routine investigative procedures in an attempt to do this.” DHS officials tell a Times reporter on the condition of anonymity that they are furious about being involved in the search. (Ferdinand 5/2003; Shenon 5/15/2003) Craddick soon orders all records of the Republicans’ search for the Democrats to be destroyed, sparking outrage among the Democrats, who demand accountability and say Craddick is trying to hide something. Questioning Family Members - Law enforcement officers have questioned the children of Representative Joe Pickett, angering Pickett’s wife Denise. And Carol Roark, the wife of Representative Lon Burnam, says police officers appeared at her home in Fort Worth and announced they were there to “arrest” her husband; one officer told her, “I’m here on the order of Tom Craddick to arrest Rep. Lon Burnam.” Roark says she laughed at the officer, and says, “I think it was a pretty silly use of tax dollars.” Dallas Mayor Laura Miller, whose husband, Representative Steve Wolens, is in Ardmore, says that police officers have camped out overnight in front of her home. Miller says, “I felt very safe last night because there were two DPS officers who slept in front of my home.” (Root 5/14/2003)
Mixed Reactions - Reaction to the Democrats’ exodus is mixed. Supporters have dubbed them the “Heroes of the House” and the “Killer D’s,” the latter a reference to a similar action taken by Texas Senate Democrats in the late 1970s. Republicans in Texas and Washington have labeled the Democratic lawmakers “cowards” and “terrorists.” Many Texas news outlets have shown sympathy to the Democrats and have criticized what some call the excessive reaction by the Republican leadership. (Smith 5/14/2003) DeLay says the Democrats who have left Texas “may not be patriots,” and adds, “Representatives are elected and paid for by the people with the expectation that they show up for work and do the people’s business and have the courage to cast tough votes.” In response, Representative Martin Frost (D-Arlington) says in regards to the redistricting plan: “Tom DeLay would be perfectly happy in the old Soviet Union. He wants one-party government. He doesn’t believe in a two-party system.” DeLay’s House colleague, Lloyd Doggett (D-TX), says, “It is easier, I think, for Tom to manipulate these lines… than it is to win elections.” (Jackson 5/14/2003; Hulse 5/15/2003)
Order Expires - The order from the Republican leadership is essentially vacated on May 15, when the Texas House, formerly “standing at ease,” officially adjourns. At that point, the “call on the House,” under which law enforcement officials are authorized to apprehend and forcibly return recalcitrant lawmakers, is abated. They return to Austin on May 16. Representative Jim Dunnam (D-Waco), who helped organize the retreat, says, “Government is by the people and for the people, and we had to go to Oklahoma to say government is not for Tom DeLay.” The delay causes the redistricting bill to lapse, but it will be brought up again in the next session, according to Texas Republicans. Representative Beverly Woolley (R-Houston) says: “Texas is a Republican state by all voting population, and they [Republicans] deserve to have greater representation in Congress. Sooner or later, we will redistrict. This is not over.” (Hulse 5/15/2003; Robison, Henderson, and Elliott 5/16/2003)
9/11 Commission Chairman Thomas Kean gives an interview to the New York Times in which he attacks the White House over its withholding of classified intelligence about al-Qaeda and attacks on the US from the Commission (see Late January 2003, June 2003, Late Summer 2003, and October 16, 2003). Although he does not mention Presidential Daily Briefs (PDBs) specifically, thinking their name secret, he says, “We’re having trouble with the White House,” meaning that a subpoena may have to be issued. He adds: “Any document that has to do with this investigation cannot be beyond our reach. I will not stand for it.” The piece runs as the lead story on page one of the newspaper, causing a good deal of criticism of President George Bush. It is picked up by Democrats, such as presidential candidate Joe Lieberman, who says, “After claiming they wanted to find the truth about September 11, the Bush administration has resorted to secrecy, stonewalling, and foot-dragging.” (Shenon 10/26/2003; Shenon 2008, pp. 215-216) As a result of this story, President Bush makes a statement identifying the documents the Commission wants as PDBs and promising to work with the Commission to give it some access. (Shenon 2008, pp. 216-217)
The Washington Post, in a laudatory profile of newly named special counsel Patrick Fitzgerald (see December 30, 2003), notes that some administration critics worry about Fitzgerald’s objectivity. Fitzgerald is close friends with the man who named him to the post, Deputy Attorney General James Comey, and is the godfather of one of Comey’s children. Senator Joseph Lieberman (D-CT) calls on Comey to “relinquish his authority to limit or interfere with the investigation.” Lieberman says Fitzgerald’s appointment means “there is still no real independence and autonomy.” (Drehle and Eggen 1/1/2004)
The Bush administration issues a terror alert in the wake of the Democratic presidential convention, which ended on July 29, 2004. New Code Orange alerts are put into effect for New York City, Newark, and Washington, DC. Homeland Security Director Tom Ridge says, “Now this afternoon, we do have new and unusually specific information about where al-Qaeda would like to attack.… Compared to previous threat reporting, these intelligence reports have provided a level of detail that is very specific. The quality of this intelligence, based on multiple reporting streams in multiple locations, is rarely seen and it is alarming in both the amount and specificity of the information.… As of now, this is what we know: reports indicate that al-Qaeda is targeting several specific buildings, including the International Monetary Fund and World Bank in the District of Columbia; Prudential Financial in Northern New Jersey; and Citigroup buildings and the New York Stock Exchange in New York.” (Department of Homeland Security 8/1/2004; Eggen and Priest 8/3/2004) But Ridge fails to mention that the so-called “casing disks” are from 2000 and 2001, nor does he discuss the fact that the decision on whether to issue the alerts had been hotly debated by officials over the weekend. Within 24 hours, the age of the intelligence is leaked, causing a controversy about the merit and urgency of the orange alert. (Suskind 2006, pp. 325-326) The next day it will be revealed that the warning was based on information from the computer of recently captured al-Qaeda operative Muhammad Naeem Noor Khan (see August 2, 2004). President Bush and his top advisors learned of the arrest and subsequent “turning” of Noor Khan just the day before. They decide to publicize an alert based on data captured with Noor Khan, even though doing so could jeopardize a sting operation launched just days earlier in which Noor Khan is contacting dozens of al-Qaeda operatives around the world (see July 24-25, 2004). (Burke, Harris, and Bright 8/8/2004) But even though Khan was arrested just weeks before, one senior law enforcement official who was briefed on the alert says, “There is nothing right now that we’re hearing that is new. Why did we go to this level?… I still don’t know that.” Homeland Security officials admit that that there is no indication that any terrorist action was imminent. “What we’ve uncovered is a collection operation as opposed to the launching of an attack,” says one. However, administration officials insist that even three-year-old intelligence, when coupled with other information about al-Qaeda’s plans to attack the US, justifies the security response in the three cities. President Bush says of the alerts, “It’s serious business. I mean, we wouldn’t be, you know, contacting authorities at the local level unless something was real.” A senior counterterrorism official says, “Most of the information is very dated but you clearly have targets with enough specificity, and that pushed it over the edge. You’ve got the Republican convention coming up, the Olympics, the elections…. I think there was a feeling that we should err on the side of caution even if it’s not clear that anything is new.” (Eggen and Priest 8/3/2004) Former Democratic presidential candidate Howard Dean says he worries “every time something happens that’s not good for President Bush, he plays this trump card, which is terrorism. It’s just impossible to know how much of this is real and how much of this is politics, and I suspect there’s some of both.” But conservatives defend the alert and Democratic presidential candidate John Kerry swiftly moves to disassociate his campaign from Dean’s remarks. (Conason 8/4/2007) Author William Rivers Pitt points out that Laura Bush and daughters Barbara and Jenna make high-profile visits to the Citigroup Center in New York City on the first day of Ridge’s new orange alert. Noting this was one of the target buildings, Pitt asks, “George W. Bush sent his entire family to the very place that was supposedly about to be blown to smithereens?” Pitt concludes, “Bush and his administration officials are using terrorism—the fear of it, the fight against it—to manipulate domestic American politics. They are, as they have every day for almost three years now, using September 11 against their own people.” (Pitt 8/4/2004)
Senator Russell Feingold (D-WI) tells reporters that he intends to push through legislation that would censure President Bush because of his domestic surveillance program (see February 2001, Spring 2001, After September 11, 2001, After September 11, 2001, October 2001, Early 2002, September 2002, Late 2003-Early 2004, April 19-20, 2004, June 9, 2005, June 9, 2005, December 15, 2005, December 17, 2005, December 19, 2005, December 24, 2005, January 5, 2006, January 18, 2006, January 18, 2006, January 23, 2006, and January 30, 2006). “What the president did by consciously and intentionally violating the Constitution and laws of this country with this illegal wiretapping has to be answered,” Feingold tells an interviewer. “Proper accountability is a censuring of the president, saying, ‘Mr. President, acknowledge that you broke the law, return to the law, return to our system of government.‘… The president has broken the law and, in some way, he must be held accountable.… Congress has to reassert our system of government, and the cleanest and the most efficient way to do that is to censure the president. And, hopefully, he will acknowledge that he did something wrong.” Senate Majority Leader Bill Frist (R-TN) calls Feingold’s proposal “a crazy political move.” The Senate Intelligence Committee, following the Bush administration’s lead, has rejected some Democrats’ call for a full investigation of the surveillance program (see February 1-6, 2006). Instead, the committee has adopted a Republican plan for a seven-member subcommittee to conduct oversight. Feingold says his censure motion is not “a harsh approach, and it’s one that I think should lead to bipartisan support.” Frist, however, says: “I think it, in part, is a political move because here we are, the Republican Party, the leadership in the Congress, supporting the president of the United States as commander in chief who is out there fighting al-Qaeda and the Taliban and Osama bin Laden and the people who have sworn—have sworn—to destroy Western civilization and all the families listening to us.… The signal that it sends that there is in any way a lack of support for our commander in chief who is leading us with a bold vision in a way that we know is making our homeland safer is wrong. And it sends a perception around the world.” Only once in history has a president been censured by Congress: Andrew Jackson in 1834. In the House, Representative John Conyers (D-MI) is exploring the idea of introducing impeachment legislation against Bush. (Files 3/12/2006; Associated Press 3/12/2006) Feingold says on the Senate floor: “The president has violated the law and Congress must respond. A formal censure by Congress is an appropriate and responsible first step to assure the public that when the president thinks he can violate the law without consequences, Congress has the will to hold him accountable.” Most Congressional Democrats want nothing to do with either Feingold’s or Conyers’s legislative ideas, and some Republicans seem to be daring Democrats to vote for the proposal. Vice President Dick Cheney tells a Republican audience in Feingold’s home state of Wisconsin, “Some Democrats in Congress have decided the president is the enemy.” Democratic leaders in the Senate thwart an immediate vote as requested by Frist, and Senator Richard Durbin (D-IL) says he is not sure the proposal will ever come to a vote. Senate Minority Leader Harry Reid (D-NV) says he does not support it and has not read it. Senator Joseph Lieberman (D-CT) makes a similar assertion. In the House, Minority Leader Nancy Pelosi (D-CA) refuses to support such a proposal, saying in a statement that she “understands Senator Feingold’s frustration that the facts about the NSA domestic surveillance program have not been disclosed appropriately to Congress. Both the House and the Senate must fully investigate the program and assign responsibility for any laws that may have been broken.” (Kellman 3/14/2006) Former Nixon aide John Dean testifies in support of Feingold’s censure motion (see March 31, 2006). However, the censure motion, lacking support from Democratic leaders and being used by Republicans as a means to attack Democrats’ patriotism, never comes to a vote. (Klein 2009, pp. 84)
The beginning of the month sees the warrantless domestic surveillance program controversy peak. The day after the Connecticut Democratic Senatorial Primary, Vice President Dick Cheney says the victory of challenger Ned Lamont over incumbent Joseph Lieberman is a victory for the “al-Qaeda types.” He says that these people are “clearly betting on the proposition that ultimately they break the will of the American people, in terms of our ability to stay in the fight.” (MSNBC 6/4/2007) Lamont will ultimately lose to Lieberman (who runs as an independent) in the general election.
A group of 14 Democratic lawmakers, led by Senator Frank R. Lautenberg, sends a letter to the inspector generals of both the Commerce Department and NASA requesting formal investigations into allegations that Bush administration political appointees suppressed evidence linking global warming to increased hurricane intensity (see 2005, October 16, 2005, October 19, 2005, and November 29, 2005- December 2005). A Senate panel finds that billions of taxpayer dollars have been wasted in reconstruction efforts throughout Iraq through fraud, corruption, incompetence, and outright theft. The panel, led by independent Democrat Joseph Lieberman and moderate Republican Susan Collins, say they are considering legislation to create a commission to help fix problems after investigators found confusion and disarray in the four-year-old Iraq reconstruction effort. Lieberman observes, "Where we’ve seen failure is when the US government failed to plan projects carefully and then failed to keep a close watch over contractors and now we’ve seen billions of dollars wasted—a cost measured not just in dollars but in the undermining of the overall US mission in these war-torn countries." Inspector General Stuart Bowen’s latest report on the occupation’s reconstruction efforts found that nearly $400 billion had either been wasted or simply disappeared, though Bowen’s report was careful not to make allegations of outright criminality. Bowen’s report primarily blames confusion, disarray, and incompetence in joint efforts between the rival Defense and State Departments. "Anyone who has spent appreciative time in the Iraq reconstructive effort understands the tension that exists between the two," Bowen says. Bowen’s latest report finds, among other things, that a Defense Department agency charged with running the reconstruction effort never developed a fully coordinated plan upon members’ arrival in 2003, leading to confusion and duplication of effort. "We were bumping into one another as we tried to solve the same problem,” a former agency official is quoted as saying. Money flowed to reconstruction projects before procedures, training and staffing were fully in place, resulting in a "lack of clearly defined authorities" and little accountability in terms of how dollars were being spent. There was little oversight to ensure that Iraqi companies hired to do reconstruction work operated according to international standards. Earlier this year, federal investigators determined that the Bush administration had squandered as much as $10 billion in reconstruction aid in part because of poor planning and contract oversight, resulting in contractor overcharges and unsupported expenses. The Protect America Act (PAA) (see August 5, 2007), an amendment to the Foreign Intelligence Surveillance Act (FISA—see 1978), is introduced in Congress. With limited debate and no committee hearings, it passes both houses with substantial majorities. (US Senate 8/5/2007; Savage 8/6/2007; House Judiciary Committee 9/18/2007 ) Congressional Democrats quickly capitulate on the bill, submitting to what the Washington Post later calls “a high-pressure campaign by the White House to change the nation’s wiretap law, in which the administration capitalized on Democrats’ fears of being branded weak on terrorism and on Congress’s desire to act on the issue before its August recess.” (Nakashima and Warrick 8/5/2007) Indeed, one Republican senator, Trent Lott, warns during the initial debate that lawmakers should pass the law quickly and get out of Washington before they could be killed in a terrorist attack (see August 2, 2007). McConnell tells the Senate, “Al-Qaeda is not going on vacation this month.” And Democrat Joseph Lieberman (D-CT), a supporter of the bill, told his colleagues: “We’re at war. The enemy wants to attack us. This is not the time to strive for legislative perfection.” (Keefe 8/6/2007)
Some Democrats Unhappy - One Democratic lawmaker responds angrily: “There are a lot of people who felt we had to pass something. It was tantamount to being railroaded.” Many House Democrats feel betrayed by the White House; Democratic leaders had reached what they believed was a deal on the bill with the Director of National Intelligence, Mike McConnell, only to have the White House throw out the deal and present a new list of conditions at the last minute. Both McConnell and the White House deny that any such deal was reached. Jan Schakowsky (D-IL), a member of the House Intelligence Committee, says, “I think the White House didn’t want to take ‘yes’ for an answer from the Democrats.” Representative Jerrold Nadler (R-NY) says lawmakers were “stampeded by fear-mongering and deception” into voting for the bill. Fellow House Democrat Jane Harman (D-CA) warns that the PAA will lead to “potential unprecedented abuse of innocent Americans’ privacy.” (Nakashima and Warrick 8/5/2007) The ACLU’s Caroline Fredrickson has a succinct explanation of why the Democrats folded so quickly: “Whenever the president says the word terrorism, they roll over and play dead.” (Keefe 8/6/2007)
AT&T Whistleblower: Democratic Leadership Colluded in Passing PAA - AT&T whistleblower Mark Klein (see July 7, 2009 and December 15-31, 2005) will later write that the Democrats played a far more active role in getting the PAA passed than others acknowledge. He will quote a 2008 column by liberal civil liberties advocate Glenn Greenwald, who will write: “[I]n 2006, when the Congress was controlled by [then-Senate Majority Leader] Bill Frist [R-TN] and [then-House Speaker] Denny Hastert [R-IL], the administration tried to get a bill passed legalizing warrantless eavesdropping and telecom amnesty, but was unable. They had to wait until the Congress was controlled by [House Majority Leader] Steny Hoyer [D-MD], [House Speaker] Nancy Pelosi [D-CA], and [Senate Majority Leader] Harry Reid [D-NV] to accomplish that.” According to Klein, once the Democrats took control of Congress in January 2007, they engaged in “pure theater, posturing as opponents of the illegal NSA program while seeking a way to protect the president.” The few principled Democrats to actively oppose the legislation, such as Senator Christopher Dodd (D-CT), were, Klein will write, “hamstrung by their own leadership.” The PAA passage was accompanied by refusals from the Democratic leaders of “the relevant Intelligence and Judiciary Committees, which were now led by Democrats such as [John D.] Rockefeller, [Dianne] Feinstein (see February 1-6, 2006), and [Patrick] Leahy in the Senate, and John Conyers and Sylvestre Reyes in the House,” who “quickly decided not to launch any serious investigations into the NSA spying.” Klein will later add that at the time of the PAA passage, he was unaware of how thoroughly Democrats had been briefed on the NSA program (see October 1, 2001, October 11, 2001, October 25, 2001 and November 14, 2001, July 17, 2003, and March 10, 2004), “and thus were in on the secret but took no action to stop it.” (Greenwald 6/19/2008; Klein 2009, pp. 86-87)
Senator John McCain (R-AZ), the presumptive Republican nominee for president, repeatedly conflates the two main warring branches of Islam in statements made while visiting the Middle East. The quickly planned trip was designed to showcase McCain’s foreign policy sagacity, and contrast him with his Democratic opponents Hillary Clinton (D-NY) and Barack Obama (D-IL), whose relative lack of experience in foreign policy is being negatively portrayed by the McCain campaign.
Allegations of Cooperation between Iran and al-Qaeda - McCain twice says while in Jordan that it is “common knowledge” that Iran, a Shi’ite-led theocracy, is training al-Qaeda terrorists and sending them into Iraq to wreak havoc. Al-Qaeda is a Sunni organization. Sunni Muslims have contended for primacy with Shi’ite Muslims for centuries; much of the violence in Iraq is between Sunni and Shi’ite insurgents. “We continue to be concerned about Iranian[s] taking al-Qaeda into Iran, training them and sending them back,” he says in one instance, and adds: “Well, it’s common knowledge and has been reported in the media that al-Qaeda is going back into Iran and receiving training and are coming back into Iraq from Iran. That’s well known. And it’s unfortunate.” His traveling companion, Senator Joseph Lieberman (D-CT), whispers a correction in McCain’s ear, and McCain promptly corrects himself, “I’m sorry, the Iranians are training extremists, not al-Qaeda.”
Criticism of McCain - The Democratic National Committee responds to McCain’s statements by saying: “After eight years of the Bush administration’s incompetence in Iraq, McCain’s comments don’t give the American people a reason to believe that he can be trusted to offer a clear way forward. Not only is Senator McCain wrong on Iraq once again, but he showed he either doesn’t understand the challenges facing Iraq and the region or is willing to ignore the facts on the ground.” (Cooper 3/18/2008; Edwards 3/18/2008)
Previous Similar Comments - McCain made a similar statement the day before while calling in to conservative radio host Hugh Hewitt’s talk show, saying, “As you know, there are al-Qaeda operatives that are taken back into Iran, given training as leaders, and they’re moving back into Iraq.” Hewitt did not correct the error. (Town Hall (.com) 3/17/2008) And on February 28, McCain told an audience in Texas, “But al-Qaeda is [in Iraq], they are functioning, they are supported in many times, in many ways by the Iranians.” (ThinkProgress (.org) 3/20/2008) McCain’s own campaign notes that McCain “immediately corrected” the error—a misstatement, as McCain made the mistake three different times in two days—and attacks the Democrats for McCain’s blunder by stating, “Democrats have launched political attacks today because they know the American people have deep concerns about their candidates’ judgment and readiness to lead as commander in chief.”
Media Reaction - Many in the mainstream media forgive or ignore McCain’s repeated gaffe. The Atlantic Monthly’s Marc Ambinder calls it “momentary confusion” on McCain’s part, again ignoring the fact that McCain made the same mistake three times in two days. (Ambinder 3/18/2008) ABC’s Jake Tapper blames the blunder on “jet lag.” (Tapper 3/18/2008) Both the Associated Press and CNN misreport McCain’s statement. Associated Press reporter Alfred de Montesquiou inaccurately reports that McCain “voiced concern that Tehran is bringing militants over the border into Iran for training before sending them back to fight US troops in Iraq, and blamed Syria for allegedly continuing to ‘expedite’ a flow of foreign fighters.” (de Montesquiou 3/18/2008) And CNN’s Emily Sherman rewrites McCain’s statement, reporting, “During a press conference in Amman, Jordan, the Arizona senator also said there is a continued concern that Iran may be training Iraqi extremists in Iran and then sending them back into Iraq.” (Sherman 3/18/2008)
Senator Joseph Lieberman (D-CT), the chairman of the Senate Homeland Security and Governmental Affairs Committee, asks Google, the parent company of the online video-sharing site YouTube, to “immediately remove content produced by Islamist terrorist organizations” from YouTube and prevent similar content from reappearing. The company refuses Lieberman’s request. Lieberman writes a letter to Eric Schmidt, the CEO and chairman of Google, saying in part that YouTube “unwittingly, permits Islamist terrorist groups to maintain an active, pervasive and amplified voice despite military setbacks or successful operations by the law enforcement and intelligence communities.” Lieberman also asks that Google identify changes it plans to make in YouTube’s community guidelines and delineate exactly what it will do to enforce those guidelines. Lieberman says removing such content ought to be “a straightforward task since so many of the Islamist terrorist organizations brand their material with logos or icons identifying their provenance.” However, YouTube responds by saying that taking such actions is not as simple as Lieberman believes, and refuses to remove any videos from anyone without consideration as to whether the videos are legal, nonviolent, or non-hate speech videos. “While we respect and understand his views, YouTube encourages free speech and defends everyone’s right to express unpopular points of view,” the company says. YouTube has removed a few videos that Lieberman identified last week after determining that the individual videos violated the company’s community guidelines. However, “most of the videos, which did not contain violent or hate speech content, were not removed because they do not violate our Community Guidelines,” the company says. Lieberman’s committee recently released a report that indicated some Islamist terrorist groups used Internet chat rooms, message boards, and Web sites to help recruit and indoctrinate members, and to communicate with one another. Some critics have said that the committee’s report unfairly singles out Muslims as possible extremists. Additionally, civil libertarians and privacy activists speak out against what they see as Lieberman’s attempt to restrain freedom of speech. John Morris of the Center for Democracy and Technology says that Lieberman’s request is a practical impossibility; worse, to have sites such as YouTube pre-screen content would radically change how the Internet is used, he says. “The government can’t get involved in suppressing videos if the content is not illegal.” (Federal Computer Weekly 5/19/2008; US Senate 5/19/2008; YouTube 5/19/2008)
Senator Joseph Lieberman (I-CT) tells a Fox News interviewer that he opposed the release of four Bush-era Justice Department memos approving torture (see April 16, 2009). “I thought release of the memos was a bad idea,” he says. “It wasn’t necessary. It just helps our enemies. It doesn’t really help us.” Lieberman then says that one of the tactics considered the harshest, waterboarding, should always be available to US interrogators. Asked if he believes waterboarding is torture, Lieberman replies: “Well, I take a minority position on this. Most people think it’s definitely torture. The truth is, it has mostly a psychological impact on people. It’s a terrible thing to do.… I want the president of the United States in a given circumstance where we believe somebody we’ve got in our control may have information that could help us stop an attack, an imminent attack on the United States like 9/11 or, God forbid, worse, we ought to be able to use something like waterboarding.” Lieberman says he believes Bush officials’ claims that waterboarding worked to prevent terrorist attacks. (Khanna 4/21/2009) Two days later, Lieberman will write that he has always “strongly opposed” waterboarding (see April 22, 2009).
A newly declassified Senate Intelligence Committee chronology discloses that the small group of Bush-era Justice Department lawyers who wrote memos authorizing the torture of enemy detainees (see April 16, 2009 and April 9, 2008) did not operate on their own, but were authorized by top White House officials such as then-Vice President Dick Cheney and then-National Security Adviser Condoleezza Rice (see April 2002 and After). Other top officials, such as then-Defense Secretary Donald Rumsfeld and then-Secretary of State Colin Powell, were apparently left out of the decision-making process. Former committee chairman John Rockefeller (D-WV) says the task of declassifying interrogation and detention opinions “is not complete,” and urges the prompt declassification of other Bush-era documents that, he says, will show how the Bush administration interpreted the laws governing torture and war crimes. The committee report began in the summer of 2008, at Rockefeller’s behest, and was drafted by committee staffers with heavy input from Bush officials. The entire effort was coordinated through the Office of the Director of National Intelligence. President Bush’s National Security Council refused to declassify the report; President Obama’s National Security Adviser, James Jones, signed off on its release and the committee clears it for release today. (Smith and Finn 4/22/2009; Talev 4/22/2009) The Intelligence Committee report dovetails with a report issued by the Senate Armed Forces Committee that showed Defense Department officials debated torture methods months before the Justice Department authorized such methods (see April 21, 2009). The report also shows:
The CIA thought al-Qaeda operative Abu Zubaida was withholding information about an imminent threat as early as April 2002 (see March 28-August 1, 2002), but did not receive authorization to torture him until three months later.
Some Senate Intelligence Committee members were briefed on the torture of Zubaida and 9/11 plotter Khalid Shaikh Mohammed in 2002 and 2003.
CIA Director George Tenet, in the spring of 2003, asked for a reaffirmation of the legality of torture methods (perhaps this memo—see June 1, 2003). Cheney, Rice, then-Attorney General John Ashcroft, and then-White House counsel Alberto Gonzales were among the participants at a meeting where it was decided that the torture policies would continue. Rumsfeld and Powell were not present.

Administration officials had lasting concerns about the legality of waterboarding as they continued to justify its legitimacy.
Reactions among other senators is divided, with John McCain (R-AZ), Lindsey Graham (R-SC), and Joseph Lieberman (I-CT) asking Obama not to prosecute Bush officials who authorized or gave advice concerning torture, and Senate Judiciary Committee chairman Patrick Leahy (D-VT) reiterating his support for an independent “truth commission” to investigate the interrogations. Two days after staunchly defending waterboarding as an interrogation tactic (see April 20, 2009), Senator Joseph Lieberman (I-CT) now claims he has always “strongly opposed” waterboarding. Lieberman, joined by Senators John McCain (R-AZ) and Lindsey Graham (R-SC), writes: “We have… strongly opposed the overly coercive interrogation techniques, including waterboarding, that these [recently released Justice Department] memos (see April 16, 2009) deemed legal. We do not believe, however, that legal analysis should be criminalized, as proposals to prosecute government lawyers suggest.” (US Senate 4/22/2009) The same day Lieberman defended the use of waterboarding, McCain, who has always opposed torture as an interrogation method, spoke out again against the practice (see April 20, 2009).
Senator Joe Lieberman (I-CT) condemns WikiLeaks for disclosing classified war documents, calling the Web site an “ideological” organization with “an agenda.” WikiLeaks “is implacably hostile to our military and the most basic requirements of our national security,” says Lieberman. He adds that readers “should be wary of drawing conclusions based on materials selectively leaked by WikiLeaks, as it seeks to sap support for the Afghan war among the American people and our European allies.” According to Lieberman: “Most of these documents add nothing to the public understanding of the war in Afghanistan. The materials—which cover the period from 2004 to 2009—reflect the reality, recognized by everyone, that the insurgency was gaining momentum during these years while our coalition was losing ground.” (Jerome 7/26/2010)
Chairman of the Senate Homeland Security Committee Joe Lieberman (I-CT) expresses doubts about designating WikiLeaks a foreign terrorist organization. Responding to a question on the Imus in the Morning radio show about a proposal from Representative Peter King (R-NY) to make such designation, Lieberman says: “Normally, we reserve that designation for groups that fit the traditional definition of terrorism, which is that they are using violence to achieve a political end.… While it’s true that what WikiLeaks did may result in damage to some people… it’s not al-Qaeda.” However, Lieberman does not rule out supporting the proposal, adding, “I want to talk to Pete and figure out what he’s got in mind.” In addition, he says that the group’s release of thousands of US documents over the past year is a “terrible thing,” and expresses the hope that “we are doing everything we can to take down their Web site.” (Fabian 11/29/2010)
Staff from the office of Senator Joe Lieberman (I-CT) contact the Internet retailer Amazon to ask about its hosting of WikiLeaks’ website. Lieberman is chairman of the Senate Committee on Homeland Security. (MacAskill 12/1/2010) His staff learns of the hosting from media accounts and leaves a series of questions, including, “Are there plans to take the site down,” with Amazon’s press secretary. (Slajda 12/1/2010) The next day, Amazon will remove the website from its servers (see December 2, 2010).
The Internet retailer Amazon cancels WikiLeaks’ server account, removing its website from its servers. The move follows pressure from Senator Joe Lieberman, chairman of the Senate Homeland Security Committee (see December 1, 2010). As a result, the WikiLeaks website is inaccessible for a time, but it soon moves to servers in Sweden. The announcement that Amazon has got rid of WikiLeaks is also made by Lieberman, who adds that the “decision to cut off WikiLeaks now is the right decision and should set the standard for other companies WikiLeaks is using to distribute its illegally seized material.” Amazon attributes the break between the two organizations to a terms of service violation by WikiLeaks. However, WikiLeaks expresses disappointment with Amazon, saying in a post on Twitter that if Amazon is “so uncomfortable with the First Amendment, they should get out of the business of selling books.” (MacAskill 12/1/2010)
