(Stoffer 10/8/2001; McBride 9/9/2011) The White House and the Eisenhower Executive Office Building next to it were evacuated at 9:45 a.m. (see (9:45 a.m.) September 11, 2001 and (9:45 a.m.) September 11, 2001). (Balz and Woodward 1/27/2002) After they left these buildings, many staffers went north to Lafayette Park, across from the White House, but were unsure what to do.
DaimlerChrysler Manager Wants Staffers to Come to His Building - Anita McBride, the acting director of White House personnel, calls her husband, Timothy McBride, who is vice president of Washington affairs for DaimlerChrysler and works at the company’s office a couple of blocks from the White House. “I knew he would know what to do even more than I,” Anita McBride will later comment, “and his immediate instinct was to bring everybody there” to the DaimlerChrysler building. Anita McBride tells her husband she is on the way to his office. She then gathers together the White House staffers who are around her and heads there. (McBride 9/9/2011; McBride 9/11/2011)
Equipment Set Up for Staffers to Use - Most of the DaimlerChrysler employees are leaving the building as the White House staffers are arriving. But before they go, they set up their computers, phones, televisions, and other resources for the White House staffers to use, and also order food for the staffers. Timothy McBride served as assistant to the president for management and administration during the administration of former President George H. W. Bush and, in that position, was responsible for many emergency procedures. “So I did have the benefit of being able to anticipate some of what the [White House] staff might need to carry on their functions,” he will comment.
Secret Service Secures the Building - After the first staffers arrive, other White House employees learn that their colleagues have assembled at the DaimlerChrysler building and go to join them. (National Journal 8/31/2002) Soon, 72 members of the White House staff have made it to the building, the largest number of White House employees currently gathered in a single location. (McBride 9/9/2011) They include speechwriters, photographers, and people from communications, the National Economic Council, Cabinet affairs, and legislative affairs. (National Journal 8/31/2002) Members of the Secret Service lock down the building and ensure that only people with White House passes are able to gain access. Anita McBride calls the White House Situation Room and lets officials there know who is at the DaimlerChrysler building. Arrangements are then made for a few senior staffers to return to the White House (see (12:00 p.m.) September 11, 2001).
White House Employees Continue Their Work - The staffers who remain at the DaimlerChrysler building quickly set up operations and continue their work. The building becomes “a White House annex,” Anita McBride will comment. (McBride 9/9/2011; McBride 9/11/2011) Some of the staffers discuss how the government can continue to function, and put together checklists of the things various federal departments and agencies should do. (Bridgeland 2012, pp. 5) Speechwriters David Frum, John McConnell, Matthew Rees, and Matthew Scully work on a speech for President Bush to deliver from the Oval Office this evening. They are assisted by another speechwriter, Michael Gerson, who is at his home in Alexandria, Virginia, but is able to communicate with them by phone. (Frum 2003, pp. 117, 120; Frum 7/7/2004; Draper 2007, pp. 140)
Officials Consider How Previous Crises Were Managed - Ken Mehlman, the White House political director, instructs Brad Blakeman, the deputy assistant to the president for appointments and scheduling, and Barry Jackson, the director of the Office of Strategic Initiatives, to go on the Internet and research what, if any, significance the date of September 11 has in the Muslim world. Mehlman also instructs Blakeman and Jackson to research how former Presidents Bill Clinton, George H. W. Bush, and Ronald Reagan responded to crises during their presidencies. And he directs Logan Walters, the president’s personal aide, and Ashley Estes, the president’s personal secretary, to come up with a schedule based on how crises were managed during past presidencies. Staffers Stay at Building until Late Afternoon - Secret Service agents periodically brief the White House staffers on what is happening in Washington and elsewhere. The staffers will remain at the DaimlerChrysler building until about 5:30 p.m., after word is received that the president is heading back to Washington. The speechwriters will then go to the White House while the other staffers will go home. (National Journal 8/31/2002; McBride 9/9/2011)
President Bush terminates an investigation into controversial Republican lobbyist Jack Abramoff by firing the US Attorney supervising the investigation. A US grand jury in Guam has been investigating a secret arrangement between Abramoff and Superior Court officials to lobby against a court reform bill pending in Congress since February 2001 that would give the newly formed Guam Supreme Court authority over the Superior Court. The bill passed. Abramoff—a $750-an-hour lobbyist and former member of the Bush-Cheney transition team—was paid by a series of $9,000 checks, totaling $324,000, funneled through Laguna Beach, California, lawyer Howard Hills. The arrangement was designed to hide Abramoff’s role in working for the Guam court. On November 18, Acting US Attorney for Guam and the Northern Mariana Islands Frederick A. Black issued a subpoena demanding that a Superior Court official turn over all records involving the lobbying contract, including bills and payments. (Black had already launched an investigation into the former governor of Guam, Carl Gutierrez, for diverting government funds for personal gain; Black apparently intended to tie the two investigations together.) However, today Black is abruptly demoted, with the White House issuing a statement announcing that it will name a replacement for him. Although Black is considered an “acting” US Attorney, he has held the post for over 10 years. Now he is demoted to an Assistant US Attorney and barred from continuing his investigations. Those investigations are now in limbo. In May 2003, Black will be replaced by Leonardo Rapadas without any Senate debate. Rapadas will be chosen for the job by Guam Republicans; lobbyist Fred Radewagen, who worked for the Gutierrez administration, will carry the recommendation to White House political chief Karl Rove in early 2003. (Radewagen has access to the top levels of the White House, including Rove.) Rapadas will quickly recuse himself from the Gutierrez investigation and the Abramoff grand jury will be dismissed. (Roche 8/8/2005; Berman 2/2/2006) Later investigation will show that Gutierrez hired Abramoff in the spring of 2002 to help him force Black out of office. “I don’t care if they appoint [B]ozo the [C]lown, we need to get rid of Fred Black,” Abramoff wrote to colleagues in March 2002. Black began investigating Abramoff for the $324,000 contract Abramoff had received, and in return Abramoff asked for help from the Justice Department (DOJ). In turn, the DOJ forwarded the information to White House counsel Alberto Gonzales. And, White House political director Ken Mehlman told White House official Leonard Rodriguez, a protege of Rove, to “reach out to make Jack [Abramoff] aware” of all Guam-related information, including people being considered to replace Black. “Abramoff claimed he had a top political guy at DOJ he could go to, to get rid of Black,” a source will tell reporter Ari Berman. In May 2002, Abramoff had a risk-assessment report of Guam and the neighboring Northern Marianas Islands (CNMI) killed; the report, requested by Black, called for the federalizing of immigration laws on the islands, a rule change that would have slowed the influx of cheap labor to CNMI, as well as jeopardizing Abramoff’s $1.6 million contract with the local government. (In CNMI, workers are paid $3.05 an hour to make clothing branded “Made in the USA.”) Abramoff learned of the report from David Ayres, then the chief of staff for Attorney General John Ashcroft, whom Abramoff hosted at a Washington Redskins football game. Not only was the report quashed, its author, regional security specialist Robert Meissner, was demoted. Meissner later told people that he thought his boss at the time, Paul McNulty, the US Attorney for Eastern Virginia, “had everything to do with” suppressing the report. McNulty later became deputy attorney general. A colleague of Meissner’s will later say: “McNulty was kind of the fireman at Justice. He was the guy trying to run around and put a lid on things that could become political, especially with Abramoff.” Another element of the effort to rid Guam of Black was to paint him as a supporter of President Clinton, although he was appointed by the first President Bush, and Gutierrez himself was a Democrat. In November 2002, Black asked the DOJ’s Public Integrity Section (PIN) for help in investigating Abramoff’s lobbying activities. McNulty was forwarded the request, as was Gonzales. The DOJ offers no help to Black. Days later, after Black convenes a grand jury to look into Abramoff’s activities, Black is removed as US Attorney. “Fred was removed because he asked to indict Abramoff,” one of Black’s colleagues at Justice will later tell Berman. “I don’t believe it was a coincidence.” In June 2006, the DOJ’s Office of the Inspector General (OIG) will determine that nothing untoward occurred in the Black firing. However, the report will be based largely on information provided by the administration, including apparently misleading testimony from Kyle Sampson, then chief of staff to Gonzales, who had by that time become attorney general. Rapadas was only chosen to replace Black after Black had launched his probe into Abramoff’s doings. David Sablan, who headed the Guam Republican Party at the time, will say in 2007, “I just wonder whether they wanted to prevent Fred Black from staying on.” The OIG report will indicate that Sampson discussed the US Attorney candidate for Guam and other posts with President Bush, a statement Bush will later disavow. Conservative radio host and former Secretary of Education William Bennett is castigated by both liberals and conservatives for his statement that aborting all black children would lower the US crime rate (see September 28-October 1, 2005). President Bush’s press secretary, Scott McClellan, tells reporters that Bush “believes the comments were not appropriate,” though he does not actually condemn Bennett’s words, as requested by House Minority Leader Nancy Pelosi (D-CA). Pelosi says: “What could possibly have possessed Secretary Bennett to say those words, especially at this time? What could he possibly have been thinking? This is what is so alarming about his words.” Senate Minority Leader Harry Reid (D-NV) says he is “appalled” by Bennett’s remarks. “The Republican Party has recently taken great pains to reach out to the African-American community, and I hope that they will be swift in condemning Mr. Bennett’s comments as nothing short of callous and ignorant,” he adds. Representative Bobby Rush (D-IL), an African-American, says, “This is precisely the kind of insensitive, hurtful, and ignorant rhetoric that Americans have grown tired of.” Rush asks “my friends, the responsible Republicans” to pass a House resolution condemning Bennett’s remarks as “outrageous racism of the most bigoted and ignorant kind.” He asks: “Where is the indignation from the GOP, as one of their prominent members talk about aborting an entire race of Americans as a way of ridding this country of crime? How ridiculous! How asinine! How insane can one be?” Instead, Rush calls for the “aborting” of Republican policies, “which have hurt the disadvantaged, the poor average Americans for the benefit of large corporations.” Bruce Gordon, president of the National Association for the Advancement of Colored People (NAACP), says Bennett and his employer, the Salem Radio Network, owe the nation an apology. “In 2005, there is no place for the kind of racist statement made by Bennett,” he says in a statement. “While the entire nation is trying to help survivors, black and white, to recover from the damage caused by Hurricanes Katrina and Rita, it is unconscionable for Bennett to make such ignorant and insensitive comments.” (CNN 9/30/2005)
Ignorance, Stereotyping Blacks as Born Criminals - In a press release, Howard Dean, the chairman of the Democratic National Committee (DNC), says: “Are these the values of the Republican Party and its conservative allies? If not, President Bush, Ken Mehlman [Dean’s Republican counterpart], and the Republican Leadership should denounce them immediately as hateful, divisive, and worthy only of scorn. This kind of statement is hardly compassionate conservatism; rather, Bennett’s comments demonstrate a reprehensible racial insensitivity and ignorance. Bill Bennett’s hateful, inflammatory remarks regarding African Americans are simply inexcusable. They are particularly unacceptable from a leader in the conservative movement and former secretary of education, once charged with the well-being of every American school child. He should apologize immediately. As Americans, we should focus on the virtues that bring us together, not hatred that tears us apart and unjustly scapegoats fellow Americans.” (Democratic National Committee 9/29/2005) Senator Patrick Leahy (D-VT), says: “I’m not even going to comment on something that disgusting. Really, I’m thinking of my black grandchild and I’m going to hold [off].” (Tapper 9/29/2005) The Reverend Jesse Jackson, a former Democratic presidential candidate and former associate of civil rights leader Dr. Martin Luther King, says: “Republicans, Democrats, and all Americans of goodwill should denounce this statement, should distance themselves from Mr. Bennett. And the private sector should not support Mr. Bennett’s radio show or his comments on the air.” (Glaister 10/1/2005)
Civil Rights Leader: Bennett's Show Should be Canceled - Wade Henderson, the executive director of the Leadership Conference on Civil Rights, says an apology is insufficient; Bennett’s radio program should be canceled. Referring to inaccurate news reports that blacks were responsible for a “crime wave” in New Orleans in the aftermath of Hurricane Katrina, Henderson says, “I think African-Americans are certainly tired of being stereotyped as being responsible for the majority of crime in American society when the facts simply don’t bear that assumption out.” (CBS News 9/30/2005)
Congressional Republicans jump-start the process to renew the 1965 Voting Rights Act (VRA—see August 6, 1965 and June 29, 1989) in what media and political observers believe is an effort to outflank Democrats, who are traditionally the most staunch supporters of the bill. Key portions of the bill are set to expire in 2007, including Section 5, which requires that states, districts, and other locales with a history of racial discrimination in their electoral processes get Justice Department approval before making any changes to voting procedures. Section 5 is intended to ensure that minorities are not disenfranchised due to their race. Observers believe Republicans want to avoid a showdown over the bill in light of the upcoming midterm elections in 2006. In 1982, the Reagan administration fought Congressional Democrats over an expansion of the law, and Republicans want to make sure that scenario does not play itself out again as the midterm elections approach. Republicans also want to reach out to African-American voters, traditionally a strong Democratic voting bloc. Representative John Lewis (D-GA), a veteran of the civil rights struggle, says, “I’m not surprised at all” that Republicans want to renew the VRA and reach out to black voters. “The Republicans are reaching out to the African-American voters.… They want to make a dent with the black electorate, take some of those voters away from the Democratic side.” Lewis intends to insert language into the renewal bill that would invalidate a recent Georgia law requiring photo identification for prospective voters, a requirement he and many others say would discriminate against the poor and the elderly. Representative James Sensenbrenner (R-WI) broke with recent Republican tradition by calling on Congress to renew Section 5 and other portions of the VRA at the NAACP’s annual convention in July. “I am here to tell you publicly what I have told others privately, including the head of the Congressional Black Caucus, Rep. Mel Watt,” Sensenbrenner told the assemblage. “During this Congress we are going to extend the Voting Rights Act. We cannot let discriminatory practices of the past resurface to threaten future gains. The Voting Rights Act must continue to exist—and exist in its current form.” Sensenbrenner said at the convention that House Speaker Dennis Hastert (R-IL) considers renewal of the VRA “high on his list of issues the House will address this Congress.” A representative for Senate Majority Leader Bill Frist (R-TN) says Frist is “fired up” over renewal of Section 5. Only a few months ago, Bush appeals court nominee William Pryor, a Republican from Alabama, called Section 5 “an affront to federalism and an expensive burden that has far outlived its usefulness,” a controversial characterization that Senator Saxby Chambliss (R-GA) and other Republicans defended. In May, Attorney General Alberto Gonzales suggested that the Bush administration is not fully behind reauthorization of Section 5. Political observers say that Democrats intend to use any further Republican opposition to the VRA to claim that Republicans are insensitive to black voters, even as senior Republican strategists like Republican National Committee Chairman Ken Mehlman say they want the party to appeal to that demographic. Mehlman told the NAACP convention in July that Republican leaders had tried over the past 40 years “to benefit politically from racial polarization.” He then said, “We were wrong” to do so. 'No Deal' - Rove’s lawyer Robert Luskin says that he negotiated no deals with Fitzgerald to spare his client from prosecution: “There has never, ever been any discussion of a deal in any way, shape, or form.” (Jeralyn Merritt 6/13/2006)
'A Chapter that Has Ended' - The decision follows months of wrangling between Fitzgerald’s team and Luskin. Neither Fitzgerald nor Luskin give any details about the issues and actions behind the decision, but Luskin says, “We believe that the special counsel’s decision should put an end to the baseless speculation about Mr. Rove’s conduct.” Rove spokesman Mark Corallo says that Rove made no deals with Fitzgerald to cooperate with the investigation, and that the decision is based solely on Fitzgerald’s findings. President Bush says of the news: “It’s a chapter that has ended. Fitzgerald is a very thorough person. I think he’s conducted his investigation in a dignified way. And he’s ended his investigation.… There’s still a trial to be had. And those of us involved in the White House are going to be very mindful of not commenting on this issue.” Christopher Wolf, a lawyer for Plame Wilson and her husband, Joseph Wilson, says that the couple is considering filing a civil suit against Rove. “The day still may come when Mr. Rove and others are called to account in a court of law for their attacks on the Wilsons,” Wolf says. Rove 'Elated' - Corallo describes Rove as “elated” over the news. Legal analyst Andrew Cohen says: “Prosecutors have ethical obligations not to indict someone when they don’t think they can win at trial and I suspect that may be what happened here. For whatever reason Fitzgerald the prosecutor didn’t believe he could take a case against Rove to a jury and win it.” (Alfano 6/13/2006)
A Variety of Responses - Democratic National Committee (DNC) chairman Howard Dean says of Rove: “He doesn’t belong in the White House. If the president valued America more than he valued his connection to Karl Rove, Karl Rove would have been fired a long time ago. So I think this is probably good news for the White House, but it’s not very good news for America.” (Solomon 6/13/2006) “The notion of the leak and the overall White House involvement, that ain’t over,” says Representative Rahm Emanuel (D-IL). “Obviously, we know that ‘Scooter’ Libby is not Karl Rove. But you have the vice president of the United States involved, or at least his office was involved.” Representative Henry Waxman (D-CA) says that Fitzgerald’s decision not to prosecute Rove should trigger a Congressional investigation into whether Rove mishandled classified information when he discussed Plame Wilson with reporters. Though Fitzgerald conducted a “narrow” criminal invesigation, Waxman says, Congress should examine the broader issue of whether Rove deserved to keep his high-level security clearance (see July 13, 2005). (Wallsten and Hamburger 6/14/2006) The Republican National Committee (RNC) circulates quotes from Democratic lawmakers attacking Rove under the headline of “Wrong Again: Prejudging Karl Rove Is Latest Example of Democrats’ Overheated Rhetoric and False Statements.” “What you had in this case was an unbelievable example of misjudgment for political purposes by leading Democrats,” says RNC chairman Ken Mehlman. He adds that the entire Rove imbroglio is just an example of how Democrats “rush to judgment.” Democratic leaders “owe [Rove] an apology,” Mehlman says. (Froomkin 6/13/2006; Wallsten and Hamburger 6/14/2006) Plame Wilson and her husband, former ambassador Joseph Wilson, are deeply disappointed at the decision. In 2007, Plame Wilson will write: “It was hard to process that someone who had appeared before a grand jury five times (see April 26, 2006), and had admitted that he had spoken to Robert Novak and Matt Cooper in the week before my name was published (see July 8, 2003, July 8 or 9, 2003, and 11:00 a.m. July 11, 2003), would face no consequences for his actions.… While our faith in Fitzgerald’s skills and integrity remained unshaken, we couldn’t help but wonder, along with everyone else, what the special prosecutor had received or heard from Rove to prompt his decision.” (Wilson 2007, pp. 250) Criminal defense lawyer Jeralyn Merritt, writing for the progressive blog TalkLeft, writes that she believes Rove has “cooperated with Fitzgerald by testifying to the grand jury five times and providing whatever information he had without a safety net. Without a 5k. Without assurances he would not be indicted. That’s a hell of a risk, but Luskin pulled it off. My hat’s off to Luskin.… I’m ready to put this to bed. Karl Rove walked. He’s one of the rare subjects of an investigation who was able to talk his way out of an indictment.” (Jeralyn Merritt 6/13/2006) Former prosecutor and blogger Christy Hardin Smith, writing for the progressive blog FireDogLake, writes: “If Luskin is coming out and saying publicly that they got a letter from Pat Fitzgerald which says that Rove will not be charged, there are two things that I want to see and know: (1) what does the letter actually say, word for word; and (2) does it say something along the lines of ‘Please thank Karl for his cooperation in this matter.’” Smith adds: “Patrick Fitzgerald and his team are career professionals. You do not charge someone with a criminal indictment merely because they are scum. You have to have the evidence to back up any charges—not just that may indicate that something may have happened, but you must have evidence that criminal conduct occurred and that you can prove it. You charge the evidence you have, you try the case you can make, and you don’t go down a road that will ultimately be a waste of the public’s money and time once you have ascertained that the case is simply not there. It doesn’t mean that you don’t think the SOB that you can’t charge isn’t a weasel or guilty as hell, it just means that you can’t prove it. (And, fwiw [for what it’s worth], those times are the worst of your career, because you truly hate to let someone go when you know in your gut they’ve done something wrong.)” (Christy Hardin Smith 6/13/2006)
