The Pentagon claims the US diplomats are there to familiarize themselves with the situation on the ground and the generals “just happened to be along,” but in appears in fact these meetings are part of a US effort to help the Croats and Muslims work together in upcoming offensives. Following this visit, US “logistics advisers” move into key locations throughout Bosnia, including the UN-controlled Tuzla airport. US Special Forces help build a secret airstrip in Visoko, central Bosnia, to land heavy transport aircraft (see Late 1994-Late 1995), and mysterious flights begin arriving at the Tuzla airports a few months later (see February-March 1995). [Observer, 11/20/1994; Scotsman, 12/3/1995] Hayden will later become head of the NSA and then head of the CIA.
A lieutenant general meets with Qwest CEO Joe Nacchio and Dean Wandry, who heads Qwest’s government business unit. According to documents filed in 2006 by Nacchio
concerning his trial on insider trading charges (see October 12, 2007), the general “told Mr. Wandry that he ran the largest telecom operation in the world, he had looked at Qwest’s network, and he wanted to use it for government purposes.” The general in question could be NSA Director Kenneth Minihan, who will be replaced in 1999 by another lieutenant general, Michael Hayden, but neither Minihan nor Hayden will comment on the allegation. Many former intelligence officials will say that it is likely Minihan who met with Nacchio and Wandry. Nacchio’s court documents indicate that he and Wandry agree to work with the general. Nacchio is not allowed to announce the contract publicly, but according to the court documents, he “understood at the time this was the beginning of a relationship which had enormous potential for future work. This proves increasingly true as time went on.” By 1999 Qwest is working extensively with the NSA. Minihan is particularly concerned about the potential of “cyberwarfare” by foreign governments, terrorist organizations, drug cartels, and organized crime, a prospect which he felt the NSA is unprepared. He particularly worries about Russia and China; in June 1998, he will testify are training personnel in potential cyber-attacks. “These opportunists, enabled by the explosion of technology and the availability of inexpensive, secure means of communication, pose a significant threat to the interests of the United States and its allies,” Minihan will state. In 2007, a former senior NSA official will say that the agency felt those groups knew US privacy laws all too well and were capable of using those laws against the NSA and other intelligence agencies. He will say, “There was such a nuanced understanding of how to tie us in knots and use American law against us, that there were certainly pockets of people saying, ‘We’ve got to be assertive; we’ve got to be more aggressive on this.’” Hayden, Minihan’s successor, will be particularly willing to push agency operations to the edge of legality. After 9/11, Hayden will say, “We’re pretty aggressive within the law. As a professional, I’m troubled if I’m not using the full authority allowed by law.” [National Journal, 11/2/2007] The NSA will approach Qwest will a similar offer in the months before 9/11 (see February 2001).
Al-Qaeda operatives use a communications hub in Sana’a, Yemen, to “put everything together” before the bombing of the USS Cole. The communications hub is run by Ahmed al-Hada, who US officials will later describe as “a prominent al-Qaeda member who is believed to have been involved in the Cole bombing.” The hub is monitored by US intelligence from 1998, at least, (see Late August 1998) and information gleaned from it is used to thwart a number of plots (see Late 1998-Early 2002). The US monitors the house through bugs planted inside and through spy satellites to monitor people leaving and entering it. The hub was also used before the 1998 embassy bombings and will be used to communicate with the 9/11 hijackers before 9/11 (see Early 2000-Summer 2001). [MSNBC, 2/14/2002; Mirror, 6/9/2002; MSNBC, 5/2005] When the FBI arrives in Yemen to investigate the bombing, it finds that “telephone records show[…] that suspects in the Cole bombing had been in touch with suspects from the 1998 embassy bombings in Kenya.” [Miller, Stone, and Mitchell, 2002, pp. 238] Calls between the hub and an al-Qaeda cell in Ireland that seems to have a connection to the Cole bombing are also intercepted during part of this period (see Late December 1999-October 12, 2000). It is unclear why the information does not allow the NSA to thwart the plot. Despite the scope of the monitoring, NSA Director Michael Hayden will later say there were no intercepts the NSA could have exploited to stop the bombing: “When the Cole disaster took place I had brought to my desk in, in this office, every stitch of NSA reporting on the—that could in any way be related to this. And I went thought it report by report and I sent a letter out to our entire work force, which was essentially, you performed well. Keep up the good work.” [CBS News, 6/19/2002]
Richard Barlow, a former intelligence analyst who was repeatedly fired for correctly claiming that Pakistan had a nuclear weapons program (see 1981-1982, August 1987-1988 and August 4, 1989), is awarded a total of $1 million by President Bill Clinton in compensation for the treatment he received. However, Barlow does not receive the money, as the settlement has to be ratified by Congress. When it runs into procedural problems, it is moved to the Court of Federal Claims to be reviewed. After Clinton is replaced by George W. Bush, CIA Director George Tenet and NSA Director Michael Hayden assert the government’s “state secrets privilege” (see March 9, 1953) over Barlow’s entire legal claim, causing it to collapse due to lack of evidence. [Source: FrancesFarmersRevenge.com]The National Security Agency (see 1952) begins building a massive data-mining system, code-named “Trailblazer,” that is intended to sift through reams of digital communications intercepts and find nuggets of information relevant to national security. The program’s task is huge—to sort through the 2 million bits of data the NSA collects every hour—and one made even more complex by the relatively new types of wireless, Internet, cell phone, and instant messaging communications now becoming ever more commonplace. Trailblazer is strongly embraced by General Michael Hayden, who became the NSA’s director in March 1999. Hayden recognizes from the outset that the NSA is years behind the technological curve, and casts Trailblazer as the future of the agency’s intelligence gathering and sorting. In November 1999, Hayden makes Trailblazer the centerpiece of his “100 Days of Change,” his plan to transform the agency into a leaner, more efficient organization, fast-tracking the program to vault it ahead of other initiatives. “It was going to structure us to handle the digital revolution,” a former intelligence official will recall. But from the outset the program has problems: a meeting between NSA and other government officials in December 1999 is unpromising, and, according to one government oversight official, the program “kicked off with not a real great definition of what it was trying to achieve.” Program managers fail to define standard data formats to allow for the proper sorting of information. After six years, $1.2 billion in expenditures, and endless man-hours of work, the utterly failed program will be recognized as the “biggest boondoggle… in the intelligence community” (see January 2006). The CIA fails to ask the NSA for information about Nawaf Alhazmi. The CIA is monitoring a summit of al-Qaeda operatives in Kuala Lumpur, Malaysia, along with local authorities there (see January 5-8, 2000), and is aware that one of the attendees is sometimes referred to by the first name Nawaf, and one is sometimes referred to by the last name Alhazmi. However, it apparently fails to put these two names together (see January 8-9, 2000). If asked, the NSA, which has been monitoring Alhazmi’s calls for at least a year (see Early 1999), could easily have realized “Nawaf” and “Alhazmi” were the same person. The 9/11 Commission will comment, “NSA’s analysts would promptly have discovered who Nawaf was, that his full name might be Nawaf Alhazmi, and that he was an old friend of Khalid [Almihdhar].” [US Congress, 7/24/2003, pp. 145 ; 9/11 Commission, 7/24/2004, pp. 353-4] The CIA does actually tell the NSA about Almihdhar and ask for information about him (see January 10, 2000 and Mid-January 2000), but, according to author James Bamford, “inexplicably” does not do this for Alhazmi. [US Congress, 7/24/2003, pp. 156 ; Bamford, 2004, pp. 227] According to NSA director Michael Hayden, had the NSA been asked at this point, it may also have been able to identify Nawaf Alhazmi’s brother Salem, another of the hijackers. The National Security Agency seeks the assistance of global telecommunications corporation AT&T to help it set up a domestic call monitoring site to eavesdrop on US citizens’ phone communications, according to court papers filed in June 2006 as part of a lawsuit against AT&T (see October 2001). The NSA is expressly forbidden from spying on US citizens within US borders unless authorized by the Foreign Surveillance Intelligence Court (FISC) (see 1978). When the NSA program, which wiretaps phone and email communications often without court warrants, becomes public knowledge well over four years later (see December 15, 2005), President Bush, NSA Director Michael Hayden, and other White House and government officials will assert that the program was set up in response to the September 11, 2001 terrorist attacks. If the claims made in the lawsuit are accurate, these assertions are provably false. “The Bush administration asserted this became necessary after 9/11,” lawyer Carl Mayer will claim in 2006. “This undermines that assertion.” Unbeknownst to most Americans, the NSA is operating a secret “data mining” operation that, by 2006, will have compiled phone records and contact information on millions of domestic phone and email communications. The NSA project is code-named “Project Groundbreaker,” and is ostensibly an above-board attempt announced in June 2000 to have AT&T and other firms help modernize its technological capabilities. The project originally seeks to have AT&T build a network operations center that duplicates AT&T’s facility in Bedminster, New Jersey; this plan will be altered when the NSA decides it will be better served by acquiring the monitoring technology itself. The agency is seeking bids for a project to “modernize and improve its information technology infrastructure,” including the privatization of its “non-mission related” systems support. [TechWeb, 6/13/2000; Bloomberg, 6/30/2006] Groundbreaker’s privatization project is expected to provide up to $5 billion in government contracts to various private firms such as AT&T, Computer Sciences Corporation, and OAO Corporation, [Computerworld, 12/4/2000; Government Executive, 9/1/2001] and up to 750 NSA employees will become private contractors. Hayden, who has aggressively instituted a corporate management protocol to enhance productivity and has brought in numerous senior managers and agency executives from private defense firms, is a strong proponent of privatizing and outsourcing much of the NSA’s technological operations, and in 2001 will say that he wants the agency to focus on its primary task of breaking codes and conducting surveillance. Hayden does not admit that Groundbreaker is part of a larger NSA domestic surveillance program, [Government Executive, 9/1/2001] and publicly, NSA officials say that the project is limited to administrative and logistics functions. [Computerworld, 12/4/2000] The covert data mining portion of the project is code-named “Pioneer.” A former, unnamed employee of the NSA, [Bloomberg, 6/30/2006] and a former AT&T technician, Mark Klein, will provide the key information about Groundbreaker (see Late 2002, July 7, 2009 and December 15-31, 2005). Klein will say in 2006 that he saw the NSA construct a clandestine area within its switching center in San Francisco, and saw NSA technicians shunt fiber optic cable carrying Internet traffic into that area, which contains a large data bank and secret data mining hardware (see April 6, 2006). Klein will say he knew that the NSA built other such facilities in other switching locations. He will go on to say that the NSA did not work with just AT&T traffic; when AT&T’s network connected with other networks, the agency acquired access to that traffic as well. [Democracy Now!, 5/12/2006] The information about AT&T and the NSA will become public knowledge after the 2006 filing of a lawsuit against AT&T and other telecommunications firms (see May 12, 2006 and June 26, 2006).
In July 2001, NSA director Michael Hayden tells a reporter that the NSA does not monitor any US citizens without court warrants from the Foreign Intelligence Surveillance Court (FISC). “We don’t do anything willy-nilly,” Hayden says. “We’re a foreign intelligence agency. We try to collect information that is of value to American decision-makers, to protect American values, America—and American lives. To suggest that we’re out there, on our own, renegade, pulling in random communications, is—is simply wrong. So everything we do is for a targeted foreign intelligence purpose. With regard to the—the question of industrial espionage, no. Period. Dot. We don’t do that.” When asked how Americans could verify that, Hayden says that they should simply trust the NSA to police and monitor itself, along with oversight from the White House and from Congress. However, it will later come to light that the NSA began illegally monitoring US citizens from the start of the Bush administration (see Spring 2001). A former NSA official will later dispute Hayden’s account. “What do you expect him to say?” the official says. “He’s got to deny it. I agree. We weren’t targeting specific people, which is what the President’s executive order does. However, we did keep tabs on some Americans we caught if there was an interest [by the White House.] That’s not legal. And I am very upset that I played a part in it.” [Truthout (.org), 1/17/2006] Hayden also denies persistent allegations from European government officials that the agency has engaged in economic espionage to help American companies against European competitors (see April 4, 2001). In March 2001, the American Civil Liberties Union’s Barry Steinhardt says that “since there is no real check on [the NSA], there is no way to know” if they are following the law. Steinhardt says that Congress is the only real check on possible NSA abuses, but it has consistently failed to exercise any sort of aggressive oversight on the agency. [CNN, 3/31/2001]
Air Force Lt. Gen. Michael Hayden, the director of the National Security Agency (NSA), is in his office at NSA headquarters in Fort Meade, Maryland, meeting with his senior staff. His executive assistant, Cindy Farkus, comes in and informs him of the first plane hitting the World Trade Center. He later says, “The immediate image I had was a light plane, off course, bad flying.” He is able to see the initial CNN reports showing the WTC on a muted television in his office. Nevertheless, he continues with his meeting. Immediately after the second attack occurs, Farkus again comes into Hayden’s office to inform him of it. Saying that “One plane’s an accident, two planes is an attack,” Hayden immediately adjourns his meeting and requests that the agency’s top security officials be summoned to his office. Author James Bamford, who is an expert on the NSA, later comments that this is “not the way it was supposed to be. NSA was not supposed to find out about an airborne attack on America from CNN, after millions of other Americans had already witnessed it. It was supposed to find out first, from its own ultrasecret warning center, and then pass the information on to the White House and the strategic military forces” (see (8:48 a.m.-9:03 a.m.) September 11, 2001). Within the headquarters of the National Security Agency (NSA) in Fort Meade, Maryland is a little-known unit called the Defense Special Missile and Astronautics Center (DEFSMAC). According to author James Bamford, who is an expert on the NSA, the center’s purpose is “to serve as the nation’s chief warning bell for a planned attack on America. It serves as the focal point for ‘all-source’ intelligence—listening posts, early-warning satellites, human agents, and seismic detectors.” According to one former NSA official, DEFSMAC “has all the inputs from all the assets, and is a warning activity. They probably have a better feel for any worldwide threat to this country from missiles, aircraft, or overt military activities, better and more timely, at instant fingertip availability, than any group in the United States.” If they received indications that an attack was imminent, DEFSMAC officials could “immediately send out near-real-time and in-depth, all-source intelligence alerts to almost 200 ‘customers,’ including the White House Situation Room, the National Military Command Center at the Pentagon, the [Defense Intelligence Agency] Alert Center, and listening posts around the world.” Its analysts could be “closely monitoring all intercepts flooding in; examining the latest overhead photography; and analyzing data from early-warning satellites 22,300 miles above the equator. DEFSMAC would then flash the intelligence to the US Strategic Command at Offutt Air Force Base in Nebraska, NORAD at Cheyenne Mountain in Colorado, and other emergency command centers.” But on this morning, as Bamford will conclude, “DEFSMAC learned of the massive airborne attacks after the fact—not from America’s multibillion-dollar spy satellites or its worldwide network of advanced listening posts, or its army of human spies, but from a dusty, off-the-shelf TV set.” [Bamford, 2004, pp. 33-35] The NSA had in fact intercepted numerous calls between some of the hijackers in the US and an al-Qaeda communications hub in Yemen, beginning in early 2000 and ending just weeks before 9/11 (see Early 2000-Summer 2001). [MSNBC, 7/21/2004] It also intercepted two messages in Arabic on September 10, stating, “The match is about to begin,” and “Tomorrow is zero hour,” but these are supposedly not translated until September 12 (see September 10, 2001). [Washington Post, 6/20/2002] The NSA even intercepted a series of communications between 9/11 mastermind Khalid Shaikh Mohammed (KSM) and lead 9/11 hijacker Mohamed Atta beginning in the summer of 2001 (see Summer 2001), continuing to a message where KSM gives Atta the final go-ahead for the attacks on September 10, 2001 (see September 10, 2001). Michael Hayden, the director of the NSA, will later claim that the “NSA had no [indications] that al-Qaeda was specifically targeting New York and Washington… or even that it was planning an attack on US soil” (see October 17, 2002). At the National Security Agency (NSA) headquarters in Fort Meade, Maryland, Michael Hayden, the agency’s director, orders the evacuation of all nonessential personnel from the NSA complex. His two reasons for this, he later says, are “just pure safety,” and to protect the people who work at the agency by sending “them home on the dispersal plan.” In a 2007 speech, he will state that he gave this order at 9:30 a.m. But in the account of author James Bamford, around the time Hayden gives the order he hears “some early reports about the explosion at the Pentagon.” Yet the attack on the Pentagon does not occur until 9:37 (see 9:37 a.m. September 11, 2001). The reason for this discrepancy is unclear. Hayden’s evacuation order is announced over loudspeakers throughout the NSA, and many of the 16,000 employees there leave. After hearing for sure that the Pentagon has been struck and that one or more hijacked aircraft is heading toward Washington, Hayden orders the three to four thousand remaining essential personnel to immediately evacuate the agency’s three tall towers and relocate to the low-rise Ops 1 Building. However, as Hayden later says, “[W]e really couldn’t afford to move the counterterrorism shop” where experts and linguists who track terrorists’ foreign communications work, even though it is located near the top of one of the NSA’s high-rise buildings. Maureen Baginski, the NSA’s director of signals intelligence, goes up there shortly after the time of the Pentagon attack to calm down the workers who, according to Hayden, are “emotionally shattered.” [US Congress, 10/17/2002; Bamford, 2004, pp. 52-54; National Journal, 6/19/2006; Central Intelligence Agency, 5/4/2007] At 9:53, analysts in the counterterrorism office will pick up and quickly translate a phone call from a bin Laden operative in Afghanistan, apparently referring to the attacks (see 9:53 a.m. September 11, 2001).
Senator Orrin Hatch (R-UT) tells the Associated Press that the US government has been monitoring Osama bin Laden’s communications electronically, and overheard two bin Laden aides celebrating the successful terrorist attack: “They have an intercept of some information that included people associated with bin Laden who acknowledged a couple of targets were hit.” [Associated Press, 9/12/2001; ABC News, 9/12/2001] Defense Secretary Donald Rumsfeld publicly denounces the report, not as untrue, but as an unauthorized release of classified information. [New York Times, 5/21/2003; National Journal, 1/20/2006] NIMD is one of several cutting-edge data mining technologies that not only has the capability of finding keywords among millions of electronically monitored communications, but can find hidden relationships among data points, and even critique the thinking and biases of a particular analyst and suggest alternative hypotheses differing from the human analysts’ conclusion. Like other data-mining technologies, the NSA will steadfastly refuse to discuss whether NIMD is used to analyze data from domestic surveillance operations. NIMD is designed as an preliminary sort program, to keep human analysts from becoming overwhelmed by raw data. In essence, NIMD is an early-warning system. “NIMD funds research to…help analysts deal with information-overload, detect early indicators of strategic surprise, and avoid analytic errors,” according to the “Call for 2005 Challenge Workshop Proposals” released by the Advanced Research and Development Activity (ARDA). ARDA was founded in 1998 to create, design, and field new technologies for US intelligence agencies, particularly the NSA. A selected few Congressional lawmakers (see January 18, 2006) were informed that the warrantless surveillance program authorized by President George W. Bush (see Early 2002) was designed to be an early-warning system for possible terrorist attacks or plans. Assistant Attorney General William Moschella will inform the top Democrats and Republicans on the House and Senate Intelligence committees in December 2002 that the “president determined that it was necessary following September 11 to create an early-warning detection system” to prevent more attacks. He will justify the use of programs such as NIMD by claiming, as NSA director Michael Hayden and other administration officials have repeatedly claimed, that the Foreign Intelligence Surveillance Act (FISA), which allows the government to obtain warrants to conduct domestic eavesdropping or wiretapping, “could not have provided the speed and agility required for the early-warning detection system.” Many experts outside of the Bush administration feel that NIMD and other programs do not have to operate outside of the Foreign Intelligence Surveillance Act (FISA) because of limitations in the law, but because of the fact that the programs cannot meet the law’s minimum requirements for surveillance. FISA requires that any such surveillance must have a probable cause that the target is a terrorist. NIMD has no such threshold. Steven Aftergood, an expert on intelligence and government secrecy with the Federation of American Scientists, will say in 2006, “Logistically speaking, the early-warning approach may involve a significant increase in the number of surveillance actions. It may be that neither the Justice Department nor the [Foreign Intelligence Surveillance Court, which approves wiretapping warrants] is prepared to prepare and process several thousand additional FISA applications per year, beyond the 1,700 or so approved in 2004.” [National Journal, 1/20/2006] Some experts will later express the opinion that NIMD is the controversial Total Information Awareness program in a slightly different form (see February 2003 and September 2002).

Shortly after the 9/11 attacks, the NSA expands surveillance operations, relying on its own authorities; some sources indicate this includes a massive domestic data mining and call tracking program, and some contend that it is illegal. In a 2006 public briefing, NSA Director Michael Hayden will say, “In the days after 9/11, NSA was using its authorities and its judgment to appropriately respond to the most catastrophic attack on the homeland in the history of the nation.” Following an October 1 briefing by Hayden to the House Intelligence Committee, Representative Nancy Pelosi (D-CA) will write to Hayden on October 11, saying, “[Y]ou indicated that you had been operating since the September 11 attacks with an expansive view of your authorities with respect to the conduct of electronic surveillance” (see October 11, 2001). Some evidence indicates NSA domestic surveillance began even before 9/11 (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, and July 2001). No Connection to Bush-Authorized Warrantless Domestic Call Monitoring - In his 2006 remarks, Hayden will clearly distinguish between the expansion he initiates under his own authorities, and the warrantless monitoring of calls with one end outside the US authorized later by President Bush (see October 4, 2001), saying, “[E]xcept that they involved NSA, these [Hayden-authorized] programs were not related… to the authorization that the president has recently spoken about.” [Michael Hayden, 1/23/2006]
'Stellar Wind' Is Name of Hayden-Authorized Program - In 2012 interviews, former NSA official William Binney will indicate that “Stellar Wind” is the name of the surveillance program initiated by Hayden. [Wired News, 2/15/2012; Democracy Now!, 4/20/2012] Some sources will refer to the Bush-authorized eavesdropping as being part of the Stellar Wind program. [Newsweek, 12/22/2008]
Differing Views on Authority for Surveillance - In his 2006 briefing, Hayden will say the Fourth Amendment only protects Americans against “unreasonable search and seizure,” and that 9/11 changed what was to be considered “reasonable.” Specifically, if communications are believed to have “[i]nherent foreign intelligence value,” interception of these communications is reasonable. In addition to referring to Hayden’s “view of [his] authorities” as “expansive,” Pelosi’s letter will give another indication that the NSA’s new standard is significantly broader than it was previously, stating, “You indicated that you were treating as a matter of first impression, [redacted] being of foreign intelligence interest.” Hayden will publicly clarify in 2006 that the authority for the NSA’s operational expansion exists under an Executive Order issued by President Reagan, saying, “These decisions were easily within my authorities as the director of NSA under and [sic] executive order; known as Executive Order 12333.” And, he will say, “I briefed the entire House Intelligence Committee on the 1st of October on what we had done under our previously existing authorities” (see October 1, 2001). In her October 11 letter, Pelosi will also write of having concerns about the program that haven’t been resolved due to restrictions on information-sharing with Congress imposed by Bush (see October 11, 2001). Binney, who pioneered the development of certain NSA data mining and surveillance technologies, will come to believe that what the NSA is doing is unconstitutional; he will first take his concerns to Congress (see Before October 31, 2001) and then resign on October 31 (see October 31, 2001). Surveillance Involves Domestic Communications - In his 2006 remarks, Hayden will not say the NSA is only targeting foreign communications under his post-9/11 authorization. Rather, the context of his remarks will indicate he is referring to domestic communications. More specifically, Hayden will state: “If the US person information isn’t relevant, the data is suppressed. It’s a technical term we use; we call it ‘minimized.’ The individual is not even mentioned. Or if he or she is, he or she is referred to as ‘US Person Number One’ or ‘US Person Number Two.’ Now, inherent intelligence value. If the US person is actually the named terrorist, well, that could be a different matter.” Hayden will also reveal that information is being passed to the FBI, an investigative agency with a primarily domestic jurisdiction, saying, “[A]s another part of our adjustment, we also turned on the spigot of NSA reporting to FBI in, frankly, an unprecedented way.” [Michael Hayden, 1/23/2006] One of Pelosi’s statements in her letter to Hayden may indicate an aspect of the domestic component: “You indicated that you were treating as a matter of first impression, [redacted] being of foreign intelligence interest,” she will write. [Nancy Pelosi, 1/6/2006] In a 2011 interview with Jane Mayer published in the New Yorker, Binney will say the NSA was obtaining “billing records on US citizens” and “putting pen registers [call logs] on everyone in the country.” [New Yorker, 5/23/2011] And in a 2012 Wired article, NSA expert James Bamford will write that Binney “explains that the agency could have installed its tapping gear at the nation’s cable landing stations—the more than two dozen sites on the periphery of the US where fiber-optic cables come ashore. If it had taken that route, the NSA would have been able to limit its eavesdropping to just international communications, which at the time was all that was allowed under US law. Instead it chose to put the wiretapping rooms at key junction points throughout the country—large, windowless buildings known as switches—thus gaining access to not just international communications but also to most of the domestic traffic flowing through the US.” Binney’s account is supported by other sources (see October 2001). [Wired News, 2/15/2012]
Surveillance Program Is Massive - Bamford, citing Binney, will write: “Stellar Wind… included not just eavesdropping on domestic phone calls but the inspection of domestic email. At the outset the program recorded 320 million calls a day, he says, which represented about 73 to 80 percent of the total volume of the agency’s worldwide intercepts.” It is unclear exactly when this level of surveillance began. According to whistleblower AT&T employee Mark Klein, construction of secret rooms splitting communications traffic does not begin until Fall 2002 (see Fall 2002). Bamford will write that Binney says, “[T]he taps in the secret rooms dotting the country are actually powered by highly sophisticated software programs that conduct ‘deep packet inspection,’ examining Internet traffic as it passes through the 10-gigabit-per-second cables at the speed of light.” [Wired News, 2/15/2012] Also, Binney’s remark to Jane Mayer that the NSA was “putting pen registers on everyone in the country” indicates the broad scope of the program. NSA director Michael Hayden addresses the NSA in a global videoconference, saying that the NSA, like other government agencies, will have to do more to protect the country from further terrorist attacks. The challenge, he says, is to balance Americans’ security with civil liberties, “to keep America free by making Americans feel safe again.” Hayden will say in a 2006 speech reflecting on that videoconference (see January 23, 2006) that US citizens operate under misconceptions about the NSA’s capabilities—that while citizens believe the NSA has a global electronic surveillance network that can, and does, spy on citizens willy-nilly, in reality the NSA is understaffed and unprepared to handle the technological advances of the last decade. Hayden will say that with more extensive domestic surveillance of US citizens and foreign visitors, the NSA could have caught some of the 9/11 hijackers before they were able to put their plan into motion. The standards by which US citizens and foreign visitors are monitored must change, Hayden believes.
Expansion of NSA Surveillance Powers - Using Ronald Reagan’s 1981 executive order 12333 (see December 4, 1981), Hayden expands the NSA’s domestic surveillance practices to eavesdrop, sometimes without court approval, on selected international calls made by US citizens. Though Hayden’s expansion of NSA surveillance is not directly authorized by President Bush, and is not the same program as authorized by Bush’s secret executive order of 2002 (see Early 2002), Hayden will later say that this expansion is based on the intelligence community’s assessment “of a serious and continuing threat to the homeland.” Hayden’s program is reviewed and approved by lawyers at the NSA, the Justice Department, and the White House, as well as Attorney General John Ashcroft. Domestic Surveillance Began Before 9/11? - Though Bush officials admit to beginning surveillance of US citizens only after the 9/11 attacks, some evidence indicates that the domestic surveillance program began some time before 9/11 (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, and July 2001).
According to author Ronald Kessler’s November 2007 book The Terrorist Watch, the NSA’s domestic surveillance program begins around two weeks after the 9/11 attacks, when President Bush meets with NSA director Michael Hayden and other NSA officials in the Oval Office. According to chief of staff Andrew Card, in attendance, Bush asks, “What tools do we need to fight the war on terror?” Hayden suggests revamping NSA guidelines to allow the agency to wiretap domestic phone calls and intercept e-mails to and from terror suspects if one end of the communication is overseas. Kessler gives the following rather lurid example: “Thus, if [Osama] bin Laden were calling the US to order the detonation of a nuclear device, and the person he called began making overseas calls, NSA could listen in to those calls as well as to bin Laden’s original call.” Kessler is a chief correspondent for the extremist conservative Web site NewsMax; his assertion is disputed by evidence suggesting that the domestic surveillance program began well before the 9/11 attacks (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, and July 2001). [Kessler, 2007, pp. 130]
NSA Director Michael Hayden briefs the House Intelligence Committee on the NSA’s efforts to combat terrorism. Though the NSA is already working on a domestic wiretapping program to spy, without warrants, on US citizens (see Early 2002), Hayden does not mention the program to the committee members, but merely discusses the ramifications of President Reagan’s Executive Order 12333 (see December 4, 1981 and September 13, 2001) on NSA functions. He does not mention that Reagan’s executive order forbids warrantless surveillance of US citizens “unless the Attorney General has determined in each case that there is probable cause to believe that the technique is directed against a foreign power or an agent of a foreign power.” On October 11, committee member Nancy Pelosi (D-CA) will write to Hayden expressing her concerns about the warrantless nature of the NSA wiretaps (see October 11, 2001). President Bush issues a directive authorizing the National Security Agency (NSA) to operate a warrantless domestic surveillance program. Author/journalist Jane Mayer will report in 2011, “[O]n October 4, 2001, Bush authorized the policy, and it became operational by October 6th,” and, “[t]he new policy, which lawyers in the Justice Department justified by citing President Bush’s executive authority as commander in chief, contravened a century of constitutional case law.” Mayer will interview NSA whistleblower Thomas Drake for her article and quote him as saying that, following the October 4 directive, “strange things were happening. Equipment was being moved. People were coming to me and saying, ‘We’re now targeting our own country!’” Bush’s directive is based on a legal opinion drafted by Department of Justice Office of Legal Counsel Deputy Attorney General John Yoo (see September 25, 2001). Conflicting Information regarding Date of First Authorization - The existence of the NSA’s domestic surveillance program will first be made public in December 2005, following reporting by the New York Times that will cite “[n]early a dozen current and former officials” (see December 15, 2005). The Times article will state that in 2002, “[m]onths after the Sept. 11 attacks,” Bush signed an executive order authorizing the NSA to monitor domestic phone calls, including those of US citizens and permanent residents, if one end of the call was outside the country. The Times article also mentions an NSA “‘special collection program’ [that] began soon after the Sept. 11 attacks, as it looked for new tools to attack terrorism.” The difference between the October 4, 2001 directive and the 2002 executive order referred to by the Times is unclear. Other Sources for October Directive - Other sources, including Bush, NSA Director General Michael Hayden, and the inspectors general of five separate agencies, will later refer to a presidential order having been given in “October,” or “weeks” after the 9/11 attacks, and say that, subsequent to this order, international calls of US persons are targeted for content-monitoring. Following the publication of the Times article, Bush will say in a December 17, 2005 radio address: “In the weeks following the terrorist attacks on our nation, I authorized the National Security Agency, consistent with US law and the Constitution, to intercept the international communications of people with known links to al-Qaeda and related terrorist organizations. Before we intercept these communications, the government must have information that establishes a clear link to these terrorist networks” (see December 17, 2005). This presidential authorization was based on a legal opinion drafted by Department of Justice Office of Legal Counsel attorney John Yoo (see October 18, 2001). [WhiteHouse(.gov), 12/17/2005] Hayden, in public remarks on January 23, 2006, will refer to a presidential authorization for monitoring domestic calls having been given prior to “early October 2001,” which is when he “gathered key members of the NSA workforce… [and] introduced [the NSA’s] new operational authority to them.” Hayden will also say, “The lawfulness of the actual authorization was reviewed by lawyers at the Department of Justice and the White House and was approved by the attorney general,” and that “the three most senior and experienced lawyers in NSA… supported the lawfulness of this program.” [Michael Hayden, 1/23/2006] In a July 10, 2009 jointly-issued report, the inspectors general of the Department of Defense, Department of Justice, CIA, NSA, and Office of the Director of National Intelligence will refer to the “President’s Surveillance Program” (PSP) and “the program’s inception in October 2001.” The report will say: “One of the activities authorized as part of the PSP was the interception of the content of communications into and out of the United States where there was a reasonable basis to conclude that one party to the communication was a member of al-Qaeda or related terrorist organizations.… The attorney general subsequently publicly acknowledged the fact that other intelligence activities were also authorized under the same presidential authorization, but the details of those activities remain classified.” [Inspectors General, 7/10/2009] Citing “a senior administration official,” the Washington Post will report on January 4, 2006: “The secret NSA program… was authorized in October 2001.… The president and senior aides have publicly discussed various aspects of the program, but neither the White House, the NSA, nor the office of the director of national intelligence would say what day the president authorized it.” [Washington Post, 1/4/2006]

Nancy Pelosi. [Source: US Congress]House Minority Leader Nancy Pelosi (D-CA) writes to NSA Director Michael Hayden questioning the nature and extent of the apparently illegal warrantless wiretapping of US citizens by the agency. Pelosi and other members of the House Intelligence Committee were briefed on October 1, 2001, by Hayden, whose agency began conducting surveillance against US citizens after the 9/11 attacks (see After September 11, 2001). Pelosi will release the letter on January 6, 2006, three weeks after the New York Times revealed that the NSA had been conducting electronic surveillance of US citizens without warrants since at least 2002 (see December 15, 2005.) Pelosi’s office will also release Hayden’s response, but almost the entire letter from Hayden is redacted.
Letter to Hayden - Pelosi writes in part, “[Y]ou indicated [in the briefing] that you had been operating since the September 11 attacks with an expansive view of your authorities with respect to the conduct of electronic surveillance under the Foreign Intelligence Surveillance Act and related statutes, orders, regulations, and guidelines.… For several reasons, including what I consider to be an overly broad interpretation of President Bush’s directive of October 5 on sharing with Congress ‘classified or sensitive law enforcement information’ it has not been possible to get answers to my questions. Without those answers, the concerns I have about what you said on the First can not be resolved, and I wanted to bring them to your attention directly. You indicated that you were treating as a matter of first impression, [redacted ] being of foreign intelligence interest. As a result, you were forwarding the intercepts, and any information [redacted ] without first receiving a request for that identifying information to the Federal Bureau of Investigation. Although I may be persuaded by the strength of your analysis [redacted ] I believe you have a much more difficult case to make [redacted ] Therefore, I am concerned whether, and to what extent, the National Security Agency has received specific presidential authorization for the operations you are conducting. Until I understand better the legal analysis regarding the sufficiency of the authority which underlies your decision on the appropriate way to proceed on this matter, I will continue to be concerned.” The only portion of Hayden’s October 18 reply regarding Pelosi’s concerns that has not been redacted reads, “In my briefing, I was attempting to emphasize that I used my authorities to adjust NSA’s collection and reporting.” In January 2006, an NSA official will say that Pelosi’s concerns were adequately addressed in Hayden’s reply, and in a private briefing shortly thereafter. Nature of Hayden's EO 12333 Surveillance Program - The full scope of Hayden’s surveillance program is unclear, but some sources indicate it includes the wholesale collection and data-mining of phone records provided by telecom companies and placement of pen registers (call trackers) on domestic phone numbers (see After September 11, 2001, October 11, 2001, After September 11, 2001, Late September, 2001, October 2001), and October 31, 2001). Some sources indicate the NSA began large-scale domestic surveillance activities prior to the 9/11 attacks (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, and July 2001).
Vice President Dick Cheney summons the chairmen and ranking members of the Senate and House Intelligence Committees to the White House for a classified briefing on the secret NSA warrantless wiretapping program (see Early 2002). Cheney makes it clear to the lawmakers that he is merely informing them about the program, and not seeking their approval. [Washington Post, 12/18/2005] Officials later say that under any of the previous presidents, such a meeting of this import would involve the president. But the four lawmakers are hustled away from the Oval Office. Instead, “[w]e met in the vice president’s office,” Bob Graham (D-FL), the chairman of the Senate Intelligence Committee, later recalls. President Bush has already told Graham that “the vice president should be your point of contact in the White House.” Cheney, according to the president, “has the portfolio for intelligence activities.” [Washington Post, 6/24/2007] The leaders are briefed by Cheney, CIA Director George Tenet, and NSA Director Michael Hayden. The Congressional leaders will later mostly refuse to comment publicly about what they do and do not learn about the program, even after it is revealed to the public (see December 15, 2005). In 2003, when Senator John D. Rockefeller ascends to the Democratic leadership of the Senate committee, and is himself briefed on the program, he will write to Cheney expressing his concerns over it (see July 17, 2003). 'No Discussion about Expanding' NSA Wiretapping - In December 2005, after the program is revealed to the public, one of the Congressmen present at the briefings, Graham, the then-chairman of the Senate Intelligence Committee, will discuss his knowledge of the program. In contradiction to the characterizations of Bush and other White House officials, Graham will say that he recalls “no discussion about expanding [NSA eavesdropping] to include conversations of US citizens or conversations that originated or ended in the United States,” and knew nothing of Bush’s intention to ignore the Foreign Intelligence Surveillance Court (also known as the FISA court). “I came out of the room with the full sense that we were dealing with a change in technology but not policy,” Graham will recall, using new methodologies to intercept overseas calls that passed through US switches. He thought that NSA eavesdropping would continue to be limited to “calls that initiated outside the United States, had a destination outside the United States but that transferred through a US-based communications system.” Instead, Graham will say, it now seems that Bush decided to go “beyond foreign communications to using this as a pretext for listening to US citizens’ communications. There was no discussion of anything like that in the meeting with Cheney.” A senior intelligence official, who refuses to reveal his identity but says he is speaking with the permission of the White House, will accuse Graham of “misremembering the briefings,” which he will call “very, very comprehensive.” The official will refuse to discuss the briefings in any but the most general terms, but will say they were intended “to make sure the Hill knows this program in its entirety, in order to never, ever be faced with the circumstance that someone says, ‘I was briefed on this but I had no idea that—’ and you can fill in the rest.” Graham will characterize the official’s description as saying: “[W]e held a briefing to say that nothing is different.… Why would we have a meeting in the vice president’s office to talk about a change and then tell the members of Congress there is no change?” House Minority Leader Nancy Pelosi (D-CA), who was also present at the meeting as the ranking Democrat on the House Intelligence Committee, will say the briefing described “President Bush’s decision to provide authority to the National Security Agency to conduct unspecified activities.” She will note that she “expressed my strong concerns” but did not go into detail. A senior NSA official, having learned of the NSA’s post-9/11 domestic surveillance program and believing it to be illegal, takes his concerns to a staff member of the House Intelligence Committee. In a 2012 interview for Democracy Now!, William Binney, a former NSA technical director who served in the NSA for 36 years, will say that some of his staff had been recruited to work on the new program and told him of some of the things that were being done, which he believed were illegal. Binney will tell co-host Juan Gonzalez: “I immediately went to the Intelligence Committee, because… the intelligence committees were formed to have oversight over the intelligence community to make sure they didn’t monitor US citizens.… And the member of the staff that I went to went to Porter Goss, who was chairman of that committee at the time, and he referred her to General Hayden for any further. When it was the job of that committee to do the oversight on all this domestic spying, they weren’t doing it.” Soon after this, Binney retires from the NSA, due to his belief the NSA is violating the Constitution (see October 31, 2001). Concerned that NSA post-9/11 surveillance operations violated the US Constitution, a senior NSA official reports on the program to House Intelligence Committee staff (see Before October 31, 2001), then retires. William Binney, a crypto-mathematician, had served in the NSA for 36 years. In 1997 he was made technical director of the World Geopolitical and Military Analysis Reporting Group, a 6000-employee unit that focused on signals intelligence (SIGINT) reporting and analysis. In the last part of his NSA career, Binney focused on dealing with the NSA’s problem of information overload, co-founding the Signals Intelligence Automation Research Center (SARC) and leading a 20-member team to develop a data-mining and analysis program called ThinThread. This program made it possible to “correlate data from financial transactions, travel records, Web searches, GPS equipment, and any other ‘attributes’ that an analyst might find useful,” and “could chart relationships among people in real time.” Unlike the NSA’s existing centralized data processing systems, ThinThread was able to identify useful or useless data as it was collected, reducing the overload problem. However, though it targeted foreign communications, ThinThread also intercepted those of Americans, and “continued documenting signals when a trail crossed into the US.” Binney incorporated measures to protect privacy, but NSA lawyers still considered the program too invasive, according to a 2011 article by Jane Mayer based on interviews with Binney and another NSA whistleblower, Thomas Drake. In 1999, NSA Director General Michael Hayden decided to fund a rival program, Trailblazer, which would be developed by defense contractors (see Late 1999). Trailblazer will be abandoned in 2006 as unworkable, after costing $1.2 billion (see January 2006). [New Yorker, 5/23/2011; Wired News, 2/15/2012; Democracy Now!, 4/20/2012]
Post-9/11 NSA Surveillance Expansion - Binney will tell Mayer that, after the 9/11 attacks, his people began coming to him, saying things like: “They’re getting billing records on US citizens! They’re putting pen registers [call logs] on everyone in the country!” James Bamford will interview Binney in 2012 and write, “At the outset the program recorded 320 million calls a day, [Binney] says, which represented about 73 to 80 percent of the total volume of the agency’s worldwide intercepts.” Binney has not been personally “read in” to this domestic surveillance program, but some members of his SARC team have, as their knowledge of ThinThread code was needed to set it up. Binney became convinced elements of ThinThread were being used, but without privacy protections, meaning US persons could be targeted. Soon after learning these things, Binney takes his concerns to the House Intelligence Committee (see Before October 31, 2001), and retires on October 31. He will tell Mayer, “I couldn’t be an accessory to subverting the Constitution.” Other sources support Binney’s account of this NSA data-mining and monitoring program (see After September 11, 2001, October 11, 2001, After September 11, 2001, Late September, 2001, and October 2001). However, the claim that NSA domestic surveillance was initiated only after, and in response to, 9/11 is contradicted by information indicating that domestic monitoring programs and activities were established and conducted prior to 9/11 (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, and July 2001). The CIA videotapes interrogations of high-value al-Qaeda detainees. The interrogations of at least two detainees are taped. One of the detainees is Abu Zubaida, who helped run a training camp in Afghanistan (see March 28, 2002 and Mid-May 2002 and After). [Central Intelligence Agency, 12/6/2007] Another is Abd al-Rahim al-Nashiri, chief of al-Qaeda operations in the Arabian peninsula (see Early October 2002 and (November 2002)). [New York Times, 12/8/2007] The tapes run to a “couple hundred hours,” and mostly show 24 hour a day coverage of Zubaida in his cell. However, some portions show aggressive interrogations, including waterboarding. According to one source, full transcripts are not made, although summaries are drafted and sent back to CIA headquarters. [Fox News, 12/13/2007; Washington Post, 12/18/2007] Another source says the opposite, “A detailed written transcript of the tapes’ contents—apparently including references to interrogation techniques—was subsequently made by the CIA.” [Newsweek, 12/11/2007] However, after tapes of Zubaida and al-Nashiri’s interrogations are destroyed in 2005 (see November 2005), some tapes are still in existence (see September 19 and October 18, 2007), suggesting that either not all tapes of their interrogations are destroyed, or that one or more other detainees are videotaped. Another detainee whose interrogations may be taped is Ramzi bin al-Shibh, because he is the most important remaining al-Qaeda leader who is captured during this time period (see June 13-September 25, 2000 and September 11, 2002). In addition, at least one audio recording is also made. [US District Court for the Eastern District of Virginia, Alexandria Division, 10/25/2007 ] According to a statement by CIA Director Michael Hayden, the interrogations are recorded because “new” procedures are used during the interrogations and the tapes are “meant chiefly as an additional, internal check on the program in its early stages.” The videotaping apparently ends in 2002. [Central Intelligence Agency, 12/6/2007] Another reason for the videotaping is said to be Abu Zubaida’s poor medical condition - he was shot several times during the operation to capture him. An intelligence official will later say, “There were concerns that there be a record of his medical treatment and condition in the event that he died.” [CBS News, 12/13/2007] However, there are various allegations these detainees are tortured (see Mid-May 2002 and After, June 16, 2004, Shortly After September 6, 2006, and March 10-April 15, 2007). Some of the tapes are destroyed in 2005 (see November 2005) and there will be a media and political outcry when this is revealed in 2007 (see December 6, 2007).
Richard Shelby (R-AL), the ranking Republican on the Senate Intelligence Committee, leaks highly classified information to Fox News political correspondent Carl Cameron just minutes after his committee learns it in a closed-door hearing with NSA Director Michael Hayden, according to later testimony. Shelby learns that telephone calls intercepted by the NSA on September 10, 2001 warned of an imminent al-Qaeda attack, but the agency failed to translate the intercepts until September 12, the day after the 9/11 attacks (see September 10, 2001). Cameron does not report the story, but instead gives the material to CNN reporter Dana Bash. A half-hour after Cameron’s meeting with Bash, CNN broadcasts the story, citing “two Congressional sources” in its report. CNN does not identify Shelby as a source. Moments after the broadcast, a CIA official upbraids committee members who have by then reconvened to continue the hearing. USA Today and the Washington Post publish more detailed stories on the NSA intercepts the next day. White House and intelligence community officials will quickly claim that the leak proves Congress cannot be trusted with classified information, but experts in electronic surveillance will later say the information about the NSA’s intercepts contains nothing harmful because it does not reveal the source of the information or the methods used to gather it. [Washington Post, 8/5/2004; National Journal, 2/15/2007] The next day, a furious Vice President Dick Cheney will threaten Senator Bob Graham (D-FL) with termination of the White House’s cooperation with the 9/11 Congressional inquiry unless Graham and his House Intelligence Committee counterpart, Porter Goss (R-FL), push for an investigation (see June 20, 2002). Shelby will deny any involvement in the leak (see August 5, 2004).

[Source: NSA]NSA Director Michael Hayden testifies before the 9/11 Congressional Inquiry that the “NSA had no [indications] that al-Qaeda was specifically targeting New York and Washington… or even that it was planning an attack on US soil.” Before 9/11, the “NSA had no knowledge… that any of the attackers were in the United States.” Supposedly, a post-9/11 NSA review found no intercepts of calls involving any of the 19 hijackers. [Reuters, 10/17/2002; US Congress, 10/17/2002; USA Today, 10/18/2002] Yet, in the summer of 2001 (see Summer 2001), the NSA intercepted communications between Khalid Shaikh Mohammed, the mastermind of the 9/11 attacks, and hijacker Mohamed Atta, when he was in charge of operations in the US. [Independent, 6/6/2002; Independent, 9/15/2002] What was said between the two has not been revealed. The NSA also intercepted multiple phone calls from al-Qaeda leader Abu Zubaida to the US in the days before 9/11 (see Early September 2001). But who was called or what was said has not been revealed. [ABC News, 2/18/2002] In addition, Hayden testified three times in secret on June 18, June 19, and July 18, but little is known about what he said, as not much information is disclosed in the media and many sections of the Inquiry’s final report about the NSA are heavily redacted. The main revelations at the time of the summer hearings are that the NSA intercepted two messages apparently pertaining to the forthcoming attack one day before 9/11, and this sparks a controversial leak inquiry by the FBI (see August 2, 2002). Assistant Attorney General William Moschella informs the ranking members of the House and Senate Intelligence committees of the administration’s use of potentially unconstitutional data mining and electronic surveillance programs after the 9/11 attacks. Moschella tells the lawmakers, “The president determined that it was necessary following September 11 to create an early-warning detection system” to prevent more attacks. One such program is the Novel Intelligence from Massive Data (NIMD) initiative (see After September 11, 2001). Moschella echoes the claims of National Security Agency director Michael Hayden and other administration officials, saying that the Foreign Intelligence Surveillance Act (FISA), which allows the government to obtain warrants to conduct domestic eavesdropping or wiretapping, “could not have provided the speed and agility required for the early-warning detection system.” [National Journal, 1/20/2006]
Domestic Surveillance Began Before 9/11? - Though Bush officials eventually admit to beginning surveillance of US citizens only after the 9/11 attacks, that assertion is disputed by evidence suggesting that the domestic surveillance program began well before 9/11 (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, July 2001, and Early 2002). Moschella informs the lawmakers of none of this.
The 9/11 Congressional Inquiry concludes its seven-month investigation of the performance of government agencies before the 9/11 attacks. A report hundreds of pages long has been written, but only nine pages of findings and 15 pages of recommendations are released at this time, and these have blacked out sections. [Los Angeles Times, 12/12/2002] After months of wrangling over what has to be classified, the final report will be released in July 2003 (see July 24, 2003). In the findings released at the present time, the inquiry accuses the Bush administration of refusing to declassify information about possible Saudi Arabian financial links to US-based Islamic militants, criticizes the FBI for not adapting into a domestic intelligence bureau after the 9/11 attacks, and says the CIA lacked an effective system for holding its officials accountable for their actions. Asked if 9/11 could have been prevented, Senator Bob Graham (D-FL), the committee chairman, gives “a conditional yes.” Graham says the Bush administration has given Americans an “incomplete and distorted picture” of the foreign assistance the hijackers may have received. [ABC News, 12/10/2002] Graham further says, “There are many more findings to be disclosed” that Americans would find “more than interesting,” and he and others express frustration that information that should be released is being kept classified by the Bush administration. [St. Petersburg Times, 12/12/2002] Many of these findings will remain classified after the inquiry’s final report is released. Senator Richard Shelby (R-AL), the vice chairman, singles out six people as having “failed in significant ways to ensure that this country was as prepared as it could have been”: CIA Director George Tenet; Tenet’s predecessor, John Deutch; former FBI Director Louis Freeh; NSA Director Michael Hayden; Hayden’s predecessor, Lieutenant General Kenneth Minihan; and former Deputy Director Barbara McNamara. [US Congress, 12/11/2002; Washington Post, 12/12/2002] Shelby says that Tenet should resign. “There have been more failures on his watch as far as massive intelligence failures than any CIA director in history. Yet he’s still there. [Source: New York Times]The CIA meets three White House officials to discuss what to do with videotapes it has made of detainee interrogations (see Spring-Late 2002). The CIA wants to destroy the tapes, so it briefs the officials on them and asks their advice. The officials are:
Alberto Gonzales, White House counsel until early 2005, when he will become attorney general;
David Addington, counsel to Vice President Dick Cheney;
John Bellinger, senior lawyer at the National Security Council;
There are conflicting accounts of the advice the lawyers give the CIA. One source will say there was “vigorous sentiment” among some unnamed top White House officials to destroy the tapes. They apparently want to destroy the tapes in 2005 because they could be damaging in the light of the Abu Ghraib scandal (see April 28, 2004). Other sources will say nobody at the White House advocates destroying the tapes. However, it seems none of the lawyers gives a direct order to preserve the tapes or says their destruction would be illegal. [New York Times, 12/19/2007] A source familiar with Bellinger’s account will say, “The clear recommendation of Bellinger and the others was against destruction of the tapes… The recommendation in 2003 from the White House was that the tapes should not be destroyed.” [Associated Press, 12/20/2007] When CIA Director Michael Hayden informs legislators of these discussions in late 2007, he will say that upon being informed high-ranking CIA officials are demanding the tapes be destroyed, the lawyers “consistently counseled caution.” The Washington Post will comment: “The ambiguity in the phrasing of Hayden’s account left unresolved key questions about the White House’s role. While his account suggests an ambivalent White House view toward the tapes, other intelligence officials recalled White House officials being more emphatic at the first meeting that the videos should not be destroyed. Also unexplained is why the issue was discussed at the White House without apparent resolution for more than a year.” [Washington Post, 12/20/2007] Another White House official, Harriet Miers, is also consulted around this time and is said to advise against the tapes’ destruction (see Between 2003-Late 2005). [New York Times, 12/19/2007] When it is revealed that these officials were consulted, Law professor Jonathan Turley will comment: “[T]his is a very significant development, because it shows that this was not just some rogue operator at the CIA that destroyed evidence being sought by Congress and the courts. It shows that this was a planned destruction, that there were meetings and those meetings extended all the way to the White House, and included Alberto Gonzalez, who would soon become attorney general and Harriet Miers, who would become White House counsel. That’s a hair’s breath away from the president himself.” [CNN, 12/19/2007]
The United Nations launches an investigation into the electronic and physical surveillance of a number of its Security Council delegates by the National Security Agency (see January 31, 2003). The NSA operation, revealed the week before, was apparently leaked to Britain’s Observer by Katharine Gun, who works at Britain’s Government Communications Headquarters (GCHQ) and has been arrested on suspicion of breaking Britain’s Official Secrets Act (see February 2003). The NSA also solicited the assistance of an intelligence agency of an unnamed “friendly foreign government”; it is believed to be Britain. The leak is touted as “more timely and potentially more important than the Pentagon Papers” by celebrated whistleblower Daniel Ellsberg. The leak of the NSA surveillance program has caused deep embarrassment for the Bush administration, which is working to recruit supporters for a second UN resolution authorizing military force against Iraq (see February 24, 2003). The authorization for the NSA operation is believed to have come from National Security Adviser Rice, but US intelligence experts say that such a decision would have had to involve Defense Secretary Donald Rumsfeld, CIA Director George Tenet, and NSA Director Michael Hayden. President Bush, by necessity, would have been informed of the proposed operation at one of his daily intelligence briefings. While such surveillance of foreign diplomats at the UN is legal under the US’s Foreign Intelligence Surveillance Act (FISA), it violates the Vienna Convention on Diplomatic Relations. According to international law expert Dr. John Quigley, the Vienna Convention stipulates: “The receiving state shall permit and protect free communication on the part of the mission for all official purposes…. The official correspondence of the mission shall be inviolable.” [Observer, 3/9/2003]

It was disclosed in 2003 that the NSA had intercepted several calls between hijackers Khalid Almihdhar, Nawaf Alhazmi, and Salem Alhazmi and an al-Qaeda communications hub in Sana’a, Yemen (see Early 2000-Summer 2001 and Summer 2002-Summer 2004). But in 2004, after revelations that the NSA has been wiretapping inside the US, some media begin to re-examine the circumstances of the hijackers’ calls from the US, as the Bush administration uses the example of these calls as a justification for the NSA’s domestic wiretapping program. [New York Times, 12/16/2005; Los Angeles Times, 12/21/2005; US President, 12/26/2005 ] The calls are thought to be a key aspect of the alleged intelligence failures before 9/11. In late 1998, the FBI had started plotting intercepts of al-Qaeda calls to and from the communications hub on a map (see Late 1998-Early 2002). According to author Lawrence Wright, “[h]ad a line been drawn from the [communications hub] in Yemen to Alhazmi and Almihdhar’s San Diego apartment, al-Qaeda’s presence in America would have been glaringly obvious.” [Wright, 2006, pp. 343-344] In 2006, former NSA Director Michael Hayden will tell the Senate that if the NSA’s domestic wiretapping program had been active before 9/11, the NSA would have raised the alarm over the presence of hijackers Khalid Almihdhar and Nawaf Alhazmi in San Diego. [CNN, 5/19/2006] However, reports in the press suggest otherwise. For example, in one newspaper a senior intelligence official will say that it was not technically possible for the NSA, which had a budget of around $3.6 billion in 2000, to trace the calls. “Neither the contents of the calls nor the physics of the intercepts allowed us to determine that one end of the calls was in the United States,” says the official. [Bamford, 2002, pp. 482; US News and World Report, 3/15/2004] But another report flatly contradicts this. “NSA had the technical ability to pick up the actual phone number in the US that the switchboard was calling but didn’t deploy that equipment, fearing they would be accused of domestic spying.” [MSNBC, 7/21/2004] It is unclear why concerns about domestic spying allegations would prevent the NSA from passing the information on to the FBI. Almihdhar and Alhazmi were not US citizens, but foreign nationals who had entered the US illegally claiming to be tourists. In addition, there was a wealth of evidence connecting them to al-Qaeda (see Early 1999, January 5-8, 2000, and Early 2000-Summer 2001). In any event, the NSA did reportedly disseminate dispatches about some of these US calls (see Spring-Summer 2000). Some FBI officials will later profess not to know what went wrong and why they were not notified of the hijackers’ presence in the US by other agencies. A senior counterterrorism official will say: “I don’t know if they got half the conversation or none of it or hung up or whatever. All I can tell you is we didn’t get anything from it—we being the people at the FBI who could have done something about it. So were they sitting on it? I don’t know.” [Los Angeles Times, 12/21/2005] The US intelligence community, through the CIA, also had access to the phone company’s records for the Yemeni communications hub, which would have shown what numbers were being called in the US (see Late 1998-Early 2002).

The CIA’s inspector general, John Helgerson, releases a highly classified report from his office that examines allegations of torture from the time period between September 2001 (after the 9/11 attacks, when the CIA first began detaining suspected terrorists and informants) and October 2003. In the report, Helgerson warns that some aggressive interrogation techniques approved for use by the CIA since early 2002 (see Mid-March 2002) might violate some provisions of the international Convention Against Torture (see October 21, 1994). The report doubts the Bush administration position that the techniques do not violate the treaty because the interrogations take place overseas on non-US citizens. It will be released, in heavily redacted form, to the public in August 2009 (see August 24, 2009). From what becomes known of the report’s contents, the CIA engaged in a number of illegal and ethically questionable tactics on the part of its interrogators. Some of these tactics include the use of handguns, power drills, threats, smoke, and mock executions. Many of the techniques used against detainees were carried out without authorization from higher officials. The report says that the CIA’s efforts to provide “systematic, clear, and timely guidance” to interrogators were “inadequate at first” and that that failure largely coincided with the most significant incidents involving the unauthorized coercion of detainees, but as guidelines from the Justice Department accumulated over several years, oversight “improved considerably.” The report does not conclude that the techniques reviewed constitute torture, but it does find that they appear to constitute cruel, inhuman, and degrading treatment under the Convention. Physical Abuse - The report defines torture as an act “intended to inflict severe physical or mental pain and suffering.” It then begins detailing such acts. Incidents of physical abuse include:
One incident caused the death of an Afghani detainee. According to the report: “An agency independent contractor who was a paramilitary officer is alleged to have severely beaten the detainee with a large metal flashlight and kicked him during interrogation sessions. The detainee died in custody.” [Central Intelligence Agency, 5/7/2004 ; New York Times, 8/24/2009; Washington Post, 8/24/2009; MSNBC, 8/25/2009] In a 2009 statement, Helgerson will write: “In one extreme case, improvisation took a disastrous turn when an agency contractor in rural Afghanistan—acting wholly outside the approved program and with no authorization or training—took it upon himself to interrogate a detainee. This officer beat the detainee and caused his death. Following an investigation of the incident, this contract employee was convicted of assault and is now in prison.” [Central Intelligence Agency, 5/7/2004 ; Washington Post, 8/24/2009]
Waterboarding was routinely used, in a manner far exceeding previously issued guidelines. Interrogators “continuously applied large volumes of water,” and later explained that they needed to make the experience “more poignant and convincing.” The CIA interrogators’ waterboarding technique was far more aggressive than anything used in military survival training such as the SERE program (see December 2001). Eventually, the agency’s Office of Medical Services criticized the waterboarding technique, saying that the “frequency and intensity” with which it was used could not be certified as “efficacious or medically safe.” [Central Intelligence Agency, 5/7/2004 ; New York Times, 8/24/2009; Washington Post, 8/24/2009] The report refers in particular to the treatment of 9/11 mastermind Khalid Shaikh Mohammed (KSM), who was reportedly waterboarded more than once (see Shortly After February 29 or March 1, 2003). Waterboarding is considered torture and is illegal in the US. The report also raises concern that the use of these techniques could eventually cause legal troubles for the CIA officers who used them. Helgerson will write: “We found that waterboarding had been utilized in a manner that was inconsistent with the understanding between CIA and the Department of Justice. The department had provided the agency a written legal opinion based on an agency assurance that although some techniques would be used more than once, repetition would ‘not be substantial.’ My view was that, whatever methodology was used to count applications of the waterboard, the very large number of applications to which some detainees were subjected led to the inescapable conclusion that the agency was abusing this technique.” [Central Intelligence Agency, 5/7/2004 ; Washington Post, 8/24/2009]
In July 2002, a CIA officer used a “pressure point” technique “with both of his hands on the detainee’s neck, the officer manipulated his finger to restrict the detainee’s carotid artery.” The carotid artery supplies the brain with oxygenated blood; such “manipulat[ion]” could lead to unconsciousness or even death. A second officer “reportedly watched his eyes to the point that the detainee would nod and start to pass out. Then the officer shook the detainee to wake him. This process was repeated for a total of three applications on the detainee.”
A technique routinely used by CIA interrogators was the “hard takedown,” which involves an interrogator grabbing a detainee and slamming him to the floor before having the detainee moved to a sleep-deprivation cell. One detainee was hauled off his feet by his arms while they were bound behind his back with a belt, causing him severe pain.
Another routinely used technique is “water dousing,” apparently a variant of waterboarding, in which a detainee is laid on a plastic sheet and subjected to having water sluiced over him for 10 to 15 minutes. The report says that at least one interrogator believed the technique to be useful, and sent a cable back to CIA headquarters requesting guidelines. A return cable explained that a detainee “must be placed on a towel or sheet, may not be placed naked on the bare cement floor, and the air temperature must exceed 65 degrees if the detainee will not be dried immediately.”
- - Detainee Abd al-Rahim al-Nashiri, suspected of plotting the 2000 bombing of the USS Cole (see October 12, 2000), was repeatedly “bathed” with hard-bristled scrub brushes in order to inflict pain. The brushes caused abrasions and bleeding. [Central Intelligence Agency, 5/7/2004 ; New York Times, 8/24/2009; Washington Post, 8/24/2009; MSNBC, 8/25/2009]
Helgerson will write: “Agency officers who were authorized to detain and interrogate terrorists sometimes failed in their responsibilities. In a few cases, agency officers used unauthorized, threatening interrogation techniques. The primary, common problem was that management controls and operational procedures were not in place to avoid the serious problems that arose, jeopardizing agency employees and detainees alike.” [Central Intelligence Agency, 5/7/2004 ; Washington Post, 8/24/2009]
Mental Abuse - Numerous instances of mental and emotional abuse were also documented.
In 2002, interrogators staged a mock execution to intimidate a detainee. CIA officers began screaming outside the room where the detainee was being interrogated. When leaving the room, he “passed a guard who was dressed as a hooded detainee, lying motionless on the ground, and made to appear as if he had been shot to death.” The report says that after witnessing this performance, the detainee “sang like a bird.”
Handguns and power drills were used to threaten detainees with severe bodily harm or death. One such instance involved al-Nashiri. An American, whose name is not released but who is identified as not being a trained interrogator and lacking authorization to use “enhanced methods,” used a gun and a power drill to frighten him. The American pointed the gun at al-Nashiri’s head and “racked” a round in the chamber. The American also held a power drill near al-Nashiri and revved it, while al-Nashiri stood naked and hooded. In 2009, reporter David Ignatius will say he finds the “image of a CIA interrogator standing with a power drill next to somebody he’s interrogating… particularly horrific, because that’s a technique that’s been used in torturing people in Iraq.” [PBS, 8/24/2009]
A CIA interrogator told al-Nashiri that if he did not cooperate with his captors, “we could get your mother in here” and “we can bring your family in here.” The report says that the interrogator wanted al-Nashiri to infer for “psychological” reasons that his female relatives might be sexually abused. The interrogator has denied actually threatening to sexually abuse al-Nashiri’s mother or other relatives.
An interrogator threatened the lives of one detainee’s children. According to the report, an “interrogator said to Khalid Shaikh Mohammed that if anything else happens in the United States, quote, ‘we’re going to kill your children.’” According to the report, the debriefer was trying to exploit a belief in the Middle East that interrogation techniques included sexually abusing female relatives in front of the detainees. It was during these same interrogation sessions that Mohammed was waterboarded 183 times in a single month (see April 16, 2009). Fear of Recriminations - According to the report, there was concern throughout the agency over the potential legal consequences for agency officers. Officers “expressed unsolicited concern about the possibility of recrimination or legal action” and said “they feared that the agency would not stand behind them,” according to the report. [Central Intelligence Agency, 5/7/2004 ; New York Times, 8/24/2009] According to the report, CIA personnel “are concerned that public revelation” of the program will “seriously damage” personal reputations as well as “the reputation and effectiveness of the agency itself.” One officer is quoted as saying he could imagine CIA agents ending up before the World Court on war crimes charges. “Ten years from now, we’re going to be sorry we’re doing this,” another officer said. But “it has to be done.” [Central Intelligence Agency, 5/7/2004 ; Washington Post, 8/24/2009] Helgerson will write: “This review of the agency’s early detention and interrogation activities was undertaken in part because of expressions of concern by agency employees that the actions in which they were involved, or of which they were aware, would be determined by judicial authorities in the US or abroad to be illegal. Many expressed to me personally their feelings that what the agency was doing was fundamentally inconsistent with long established US government policy and with American values, and was based on strained legal reasoning. We reported these concerns.” [Central Intelligence Agency, 5/7/2004 ; Washington Post, 8/24/2009]
Recommendations - The report lists 10 recommendations for changes in the treatment of detainees, but it will not be reported what these are. Eight of the recommendations are apparently later adopted. Former CIA assistant general counsel John Radsan will later comment, “The ambiguity in the law must cause nightmares for intelligence officers who are engaged in aggressive interrogations of al-Qaeda suspects and other terrorism suspects.” [New York Times, 11/9/2005]
Approval, Contradictory Statements by Attorney General - The report says that Attorney General John Ashcroft approved all of these actions: “According to the CIA general counsel, the attorney general acknowledged he is fully aware of the repetitive use of the waterboard and that CIA is well within the scope of the DOJ opinion that the authority given to CIA by that opinion. The attorney general was informed the waterboard had been used 119 times on a single individual.” In 2009, reporter Michael Isikoff will say that the contents of the report “conflict… with the public statements that have been made over the years by Bush administration officials and CIA directors.” In 2007, then-CIA Director Michael Hayden will tell the Council on Foreign Relations that the agency’s detention and interrogation program was “very carefully controlled and lawfully conducted—has been carefully controlled and lawfully conducted.” Isikoff will say, “It’s kind of hard to square that with… what was in the CIA inspector general report that had been presented five years ago in 2004.” [Central Intelligence Agency, 5/7/2004 ; MSNBC, 8/25/2009]
Questions of Effectiveness - The report does document that some interrogations obtained critical information to identify terrorists and stop potential plots, and finds that some imprisoned terrorists provided more information after being exposed to brutal treatment (see August 24, 2009). It finds that “there is no doubt” that the detention and interrogation program itself prevented further terrorist activity, provided information that led to the apprehension of other terrorists, warned authorities of future plots, and helped analysts complete an intelligence picture for senior policymakers and military leaders. But whether the harsh techniques were effective in this regard “is a more subjective process and not without some concern,” the report continues. It specifically addresses waterboarding as an illegal tactic that is not shown to have provided useful information. “This review identified concerns about the use of the waterboard, specifically whether the risks of its use were justified by the results, whether it has been unnecessarily used in some instances,” the report reads, and notes that in many instances, the frequency and volume of water poured over prisoners’ mouths and noses may have exceeded the Justice Department’s legal authorization. In the instance of detainee Abu Zubaida, the report finds, “It is not possible to say definitively that the waterboard is the reason for Abu [Zubaida]‘s increased production [of intelligence information], or if another factor, such as the length of detention, was the catalyst.” In 2009, Isikoff will note that the effectiveness of torture is not clarified by the report. “As you know, Vice President [Dick] Cheney and others who had defended this program have insisted time and again that valuable intelligence was gotten out of this program. You could read passages of this report and conclude that that is the case, that they did get—some passages say important intelligence was gotten. Cheney Blocked Report's Completion - Reporter Jane Mayer later learns that Cheney intervened to block Helgerson from completing his investigation. Mayer will write that as early as 2004, “the vice president’s office was fully aware that there were allegations of serious wrongdoing in the [interrogation] program.” Helgerson met repeatedly and privately with Cheney before, in Mayer’s words, the investigation was “stopped in its tracks.” She will call the meetings “highly unusual.” In October 2007, CIA Director Michael Hayden will order an investigation of Helgerson’s office, alleging that Helgerson was on “a crusade against those who have participated in controversial detention programs.” [Public Record, 3/6/2009]

Judge Colleen Kollar-Kotelly, the presiding judge over the Foreign Intelligence Surveillance Court (FISC), warns the Justice Department that if it does not stop using evidence collected with warrantless wiretaps to obtain warrants to continue surveillance, her court will be more reluctant to grant warrants for surveillance. Kollar-Kotelly has complained about this before (see 2004). Though both Kollar-Kotelly and her predecessor, Judge Royce Lambeth, express concerns to senior officials that Bush’s warrantless wiretapping program is inherently unconstitutional, neither judge feels that they have the authority to rule on the president’s power to order such surveillance. Instead, they work to preserve the integrity of the FISA process. Eventually, the judges reach a compromise with government lawyers: any case using evidence from warrantless wiretaps that is to be presented to the judges for FISA warrants to continue monitoring the same suspects will be “tagged,” and that evidence will not be used to obtain warrants. Those cases, numbering less than ten a year, are to be presented only to the presiding judge. Lambeth and Kollar-Kotelly both feel that the process will work primarily because of the trust they have developed in James Baker, the Justice Department’s liaison to FISC. Part of the problem stems from contradictory statements and claims from the administration; after the wiretapping program began (see After September 11, 2001, NSA chief Michael Hayden and then-Attorney General John Ashcroft made it clear in private meetings with the judges that President Bush wanted to gain all possible information on any potential terrorist attacks, and that such information-gathering must by necessity go beyond the FISA court’s probable-cause requirement. But more recent assertions by Hayden and Ashcroft’s successor, Alberto Gonzales (see December 19, 2005, claiming that NSA analysts do not listen to domestic calls unless they already have some evidence that one of the parties to the call has links to terrorism, contradict earlier administration claims to the judges. Kollar-Kotelly suspects that the entire truth of the matter is not being presented to her and the FISC. Her suspicions are validated when her court is, in spite of administration reassurances, again presented with warrant applications based on illegally obtained evidence (see Late 2005). The US intelligence community releases a National Intelligence Estimate (NIE) on Iran, the first of its kind since 2001. Its central conclusion is that Iran is about ten years away from manufacturing enough highly enriched uranium to make a nuclear weapon. That doubles the previous estimate of five years. (The “five years away” estimate has been a staple of US assertions about Iran’s nuclear program since 1995.) Even then, the report states, it is unclear whether Iran would have the technology capable of using the uranium in a functional nuclear device. The NIE gives little support for recent statements by Bush administration officials that assert Iran is working hard to develop and deploy a nuclear weapon, and that such deployment could happen much sooner than ten or even five years. President Bush has said repeatedly that while he wants to resolve the crisis with Iran diplomatically, “all options are on the table,” meaning a potential military strike is being considered. The NIE says that Iran is conducting clandestine work as part of its nuclear program, but there is no way to know if that work is on nuclear weapons development. Iran is, the report states, acquiring technologies that could be diverted to bomb-making. It is uncertain whether Iran’s ruling mullahs have decided whether to build a nuclear arsenal, the NIE says, but, according to a senior intelligence official, “it is the judgment of the intelligence community that, left to its own devices, Iran is determined to build nuclear weapons.” The White House has refrained from attributing its assertions about Iran’s nuclear program to US intelligence, as it did with Iraq before the March 2003 invasion. Instead, it has pointed to Iranian efforts to conceal its activities, and questioned why, since Iran has tremendous oil and natural gas reserves, it would need a nuclear energy program. The administration is riven with infighting and competing viewpoints on Iran’s nuclear program, and this NIE does little to resolve those differences. The NIE also says that the US intelligence community still knows far too little about Iran’s nuclear program. The intelligence community gathers most of its information from communication intercepts, satellite imagery, and reports from the UN inspectors who have been investigating Iran’s nuclear program since 2003. Those inspectors have found facilities for uranium conversion and enrichment, results of plutonium tests, and equipment bought illicitly from Pakistan, all of which raised serious concerns but could be explained by an energy program. Inspectors have found no evidence that Iran possesses a nuclear warhead design or is conducting a nuclear weapons program. Deputy Director of National Intelligence Michael Hayden says that since the October 2002 NIE, which wrongly concluded Iraq was reconstituting its nuclear program (see October 1, 2002), the rules governing the creation of NIEs have been revamped to mandate “a higher tolerance for ambiguity,” even if NIEs would be less conclusive in the process. [Washington Post, 8/2/2005] In 2007, a new NIE will conclude that Iran actually stopped work on a nuclear weapon in 2003 (see December 3, 2007).
Deputy Director of National Intelligence Michael Hayden learns that the CIA has videotaped some detainee interrogations (see Spring-Late 2002). Hayden will later say he finds this out towards the end of his time as deputy director of national intelligence, a position he leaves in May 2006. Although the tapes were destroyed several months previously (see November 2005), Hayden will later say he is not aware of their destruction at this point: “I did not personally know before they were destroyed, not at all… I was aware of the existence of the tapes but really didn’t become focused on it until the summer of ‘06.” It appears that Hayden does not inform any congressional oversight committees of the destruction until 2007 (see March 14, 2007 and December 7, 2007), even though he becomes CIA director in the summer of 2006 (see May 5, 2006). An FBI investigation into Jane Harman (D-CA), the ranking minority member of the House Intelligence Committee, is halted by Attorney General Alberto Gonzales, according to three former top national security officials. The investigation was to determine whether she agreed to use her influence on behalf of accused Israeli spies in return for Israeli support in being named chairman of the committee (see Summer 2005, October 2005 and December 2, 2006). In contrast to the former officials’ claims, the media will report that the investigation is ended due to “lack of evidence” of impropriety or illegal behavior on Harman’s part. However, according to the former officials, Gonzales wants Harman to help defend the administration’s warrantless wiretapping program, which is about to be revealed by a long-simmering New York Times story (see December 15, 2005). The evidence against Harman includes NSA wiretaps of a conversation between her and an Israeli agent. Reporter Jeff Stein will write, “As for there being ‘no evidence’ to support the FBI probe, a source with first-hand knowledge of the wiretaps called that ‘bull****.’” Another former national security officer will confirm Harman’s presence on the wiretaps. “It’s true,” the official will say. “She was on there.” Justice Department attorneys in the intelligence and public corruption units have concluded that Harman had committed what they called a “completed crime,” meaning there was evidence to show that she had attempted to complete it; they were prepared to open a case on her that would include wiretaps approved by the Foreign Intelligence Surveillance Court (FISC). CIA Director Porter Goss certified the FISA wiretapping request, and decided to inform House Speaker Dennis Hastert (R-IL) and ranking House Democrat Nancy Pelosi (D-CA) of the impending FBI investigation. At this point, say Stein’s sources, Gonzales intervenes to stop the investigation. Two officials with knowledge of the events will say that, in Gonzales’s words, he “needed Jane” to help support the warrantless wiretapping program once it became public knowledge. Gonzales tells Goss that Harman had helped persuade the Times to refrain from publishing the story in late 2004 (see Early November 2004, December 6, 2005, and Mid-2005), and although the Times would no longer wait on the story, Harman could be counted on to help defend the program. She will do just that (see December 21, 2005 and February 8-12, 2006). Hastert and Pelosi are never told of the FBI investigation. Stein will also learn that Goss’s successor, Michael Hayden, will later be informed of the potential investigation, but choose to take no action. Likewise, Director of National Intelligence John Negroponte will oppose any such investigation. Former officials who will pursue the Israeli espionage case for years will say, in Stein’s words, that “Harman dodged a bullet… [s]he was protected by an administration desperate for help.” A recently retired national security official closely involved in the investigation will add: “It’s the deepest kind of corruption. It’s a story about the corruption of government—not legal corruption necessarily, but ethical corruption.” [Congressional Quarterly, 4/19/2009]

Attorney General Alberto Gonzales and NSA chief Lieutenant General Michael Hayden conduct their own “briefing” on the recently revealed NSA wiretapping program (see December 15, 2005) with the White House press corps. Gonzales and Hayden make the following points:
Gonzales says that he will not discuss the internal workings of the still-classified program, only what he calls its “legal underpinnings.”
He claims that the program, which he calls “the most classified program that exists in the United States government,” is legal because President Bush authorized it, and says that the idea that “the United States is somehow spying on American citizens” is wrong: it is “[v]ery, very important to understand that one party to the communication has to be outside the United States.”
He says that for the NSA to eavesdrop on a US citizen’s telephone or e-mail communications, “we have to have a reasonable basis to conclude that one party to the communication is a member of al-Qaeda, affiliated with al-Qaeda, or a member of an organization affiliated with al-Qaeda, or working in support of al-Qaeda.” The wiretapping program is an essential part of the administration’s war against terror, he says.
He goes on to claim that “the authorization to use force, which was passed by the Congress in the days following September 11th, constitutes” legal grounds for “this kind of signals intelligence.” [White House, 12/19/2005] The White House signed Congress’s Authorization to Use Military Force (AUMF) into law on September 18, 2001 (see September 14-18, 2001. [White House, 9/18/2001]
Hayden Claims Supreme Court Backing - While he admits that the Congressional authorization to use force against international terrorism does not specifically mention any kind of electronic surveillance, he refers the listeners to the Supreme Court case concerning alleged US terrorist Yaser Esam Hamdi (see June 28, 2004), in which the Court ruled that Hamdi had the legal right to challenge his detention. “[T]he United States government took the position that Congress had authorized that detention in the authorization to use force, even though the authorization to use force never mentions the word ‘detention.’ And the Supreme Court, a plurality written by Justice O’Connor agreed. She said, it was clear and unmistakable that the Congress had authorized the detention of an American citizen captured on the battlefield as an enemy combatant for the remainder—the duration of the hostilities. So even though the authorization to use force did not mention the word, ‘detention,’ she felt that detention of enemy soldiers captured on the battlefield was a fundamental incident of waging war, and therefore, had been authorized by Congress when they used the words, ‘authorize the President to use all necessary and appropriate force.’ For the same reason, we believe signals intelligence is even more a fundamental incident of war, and we believe has been authorized by the Congress. And even though signals intelligence is not mentioned in the authorization to use force, we believe that the Court would apply the same reasoning to recognize the authorization by Congress to engage in this kind of electronic surveillance.”
Bush 'Very Concerned' With Protecting Civil Liberties - Gonzales insists, Bush “is very concerned about the protection of civil liberties, and that’s why we’ve got strict parameters, strict guidelines in place out at NSA to ensure that the program is operating in a way that is consistent with the President’s directives.” He adds, “[W]e feel comfortable that this surveillance is consistent with requirements of the Fourth Amendment. The touchstone of the Fourth Amendment is reasonableness, and the Supreme Court has long held that there are exceptions to the warrant requirement in—when special needs outside the law enforcement arena. And we think that that standard has been met here.”
Wiretapping Essential in Catching Terrorists - Hayden reiterates how important the wiretapping is to catching terrorists and stopping potential attacks against US targets, though he and Gonzales both refuse to say what, if any, terrorist plots or what terror suspects might have been captured through the NSA wiretapping program. Hayden does say, “This program has been successful in detecting and preventing attacks inside the United States.…I can say unequivocally, all right, that we have got information through this program that would not otherwise have been available,” though he refuses to cite specifics. He admits that there have been some errors in surveilling innocent US citizens, though he refuses to give any details, and says those errors were quickly corrected.
Administration Not Required to Go Through FISA - Gonzales, who is the main speaker in the briefing, reiterates that while the administration continues to seek warrants from the Foreign Intelligence Surveillance (FISA) court, “we are not legally required to do, in this particular case, because the law requires that we—FISA requires that we get a court order, unless authorized by a statute, and we believe that authorization has occurred.” He justifies the administration’s refusal to use the FISA court for obtaining warrants by insisting that NSA officials “tell me that we don’t have the speed and the agility that we need, in all circumstances, to deal with this new kind of enemy. You have to remember that FISA was passed by the Congress in 1978. There have been tremendous advances in technology… since then.” Hayden adds, “I don’t think anyone could claim that FISA was envisaged as a tool to cover armed enemy combatants in preparation for attacks inside the United States. And that’s what this authorization under the President is designed to help us do.”
'Balancing' of Civil Liberties, National Security - Hayden says the warrantless wiretapping program is part of “a balancing between security and liberty,” a more “aggressive” operation “than would be traditionally available under FISA. It is also less intrusive. It deals only with international calls. It is generally for far shorter periods of time. And it is not designed to collect reams of intelligence, but to detect and warn and prevent about attacks. And, therefore, that’s where we’ve decided to draw that balance between security and liberty.”
Media Leaks Damaging to National Security - Gonzales refuses to talk about when any members of Congress were briefed on the program or what they were told, but he does imply that there will be some sort of leak investigation as to how the New York Times found out about the program: “[T]his is really hurting national security, this has really hurt our country, and we are concerned that a very valuable tool has been compromised. As to whether or not there will be a leak investigation, we’ll just have to wait and see.”
No Evidence of Compromised National Security - When asked whether he can cite any evidence that the revelation of the program’s existence has actually compromised anything—“Don’t you assume that the other side thinks we’re listening to them? I mean, come on,” one reporter says—Gonzales responds, rather confusingly, “I think the existence of this program, the confirmation of the—I mean, the fact that this program exists, in my judgment, has compromised national security, as the President indicated on Saturday.”
Easier to Sidestep FISA Instead of Seek Congressional Approval - He does admit that the administration decided to sidestep the FISA court entirely instead of attempt to work with Congress to rewrite the FISA statutes because “we were advised that that would be difficult, if not impossible” to amend the law to the White House’s satisfaction. Gonzales says those who are concerned about the program being excessively intrusive or a threat to American civil liberties simply “don’t understand the specifics of the program, they don’t understand the strict safeguards within the program.… Part of the reason for this press brief today is to have you help us educate the American people and the American Congress about what we’re doing and the legal basis for what we’re doing.” He adds that any legal experts who believe the program is illegal are basing their judgments “on very limited information.”
Tough Questioning - One reporter asks an unusually tough series of questions to Gonzales: “Do you think the government has the right to break the law?”, to which Gonzales replies, “Absolutely not. I don’t believe anyone is above the law.” The reporter then says, “You have stretched this resolution for war into giving you carte blanche to do anything you want to do,” to which Gonzales replies cryptically, “Well, one might make that same argument in connection with detention of American citizens, which is far more intrusive than listening into a conversation.” The reporter insists, “You’re never supposed to spy on Americans,” and Gonzales deflects the responsibility for the decision back onto the Supreme Court.
Administration Will Tell Nation What It Needs to Know - Gonzales says the administration has no intention of releasing any of the classified legal opinions underpinning the program, and this press briefing is one of the methods by which the administration will “educat[e] the American people…and the Congress” to give them what they need to know about the program. [White House, 12/19/2005]
The National Security Agency’s ‘Trailblazer’ program (see Late 1999), envisioned in 1999 as an overarching state-of-the-art data-mining system capable of sorting through millions of telephone and Internet communications and pluck out items relevant to national security and counterterrorism, is an abject failure, according to multiple sources and reports. The program has soaked up six years of effort and $1.2 billion in taxpayer dollars, with nothing to show except some schematic drawings and a few isolated technological and analytical gadgets, and little hope of much future progress. Matthew Aid, who has advised three federal commissions and panels investigating the 9/11 attacks, says that Trailblazer is “the biggest boondoggle going on now in the intelligence community.” Part of the problem is that over its six years of development, Trailblazer has passed through three separate NSA divisions, each with its own priorities and design goals. Its overseers have failed to exert the proper authority to clearly define the program’s goals and keep the project on track. In 2003, the NSA’s inspector general found that the program suffered from “inadequate management and oversight” of private contractors and overpayment for the work that was done. The lead private contractor for the project, Science Applications International Corporation (SAIC), has not provided the technical and managerial expertise necessary to create the system. While the Bush administration has touted the NSA wiretapping program (see December 15, 2005) as vital to protecting the nation from terrorism, it allows the agency to mismanage Trailblazer, in essence allowing the agency to go increasingly “deaf” as millions of items of unimportant information overwhelm the agency’s ability to sort out key bits of information, according to a government official. A Congressional investigation of intelligence failures surrounding the 9/11 attacks found that the NSA did not sift out “potentially vital” information that could have predicted or even prevented the attacks—a lapse that Trailblazer was intended to correct. Aid says that the problem is akin to searching for a needle in a haystack that doubles in size every few months. Intelligence experts say that the problem with Trailblazer is like deciding whether to keep a piece of mail or throw it out based only on what is on the outside of the envelope. Approximately 95% of the information gathered by the NSA is discarded without ever being translated from its original binary form; the remaining 5% is turned into plain text for human analysts to survey. Trailblazer was designed to sort through this information to identify patterns, keywords, and links to other data. The program would, in theory, translate all of the information into plain text or voice data, analyze the results to identify items of interest, store the results in an easily searchable database, and forward selected items to the appropriate analysts for follow-up. But after six years of work, there will still be no consensus among agency managers and experts as how to create a system to do this. Interestingly, another, less grandiose program, code-named Thinthread, appeared promising—a 2004 Pentagon report found that Thinthread could work better and be put to use more quickly than Trailblazer—but NSA managers disagreed with the Pentagon report and canceled Thinthread. Instead, Hayden pushed the agency to get Trailblazer up and running after the 9/11 attacks, cutting into time needed for review and corrections. Internal and external warnings that the program was going off-course were ignored; because of its secrecy and technological sophistication, neither Congress nor the NSA was able to effectively monitor the progress of the program’s development. And the agency lost track of much of the $1.2 billion that was allocated by Congress for the program. NSA Inspector General Joel Brenner blames the waste and inefficiency on “inadequate management and oversight.” As of 2006, the Government Accountability Office, the investigative arm of Congress, has not investigated Trailblazer simply because no one in Congress had asked it to. Because of the impact of the 9/11 attacks, and the war in Iraq, Congress has never seriously considered cutting back or reviewing any programs such as Trailblazer that might provide information on further terrorist attacks. A memo from the nonpartisan Congressional Research Service (CRS) finds that President Bush appears to be in violation of the National Security Act of 1947 in his practice of briefing only select members of Congress on the National Security Agency’s warrantless wiretapping program. Bush has provided only limited briefings to the so-called “Gang of Eight,” the four Congressional leaders and the four ranking members of the House and Senate Intelligence Committees. But the 1947 law requires the US intelligence community to brief the full membership of both committees on the program. The memo is the result of a request by Representative Jane Harman (D-CA), who wrote Bush a letter saying that she believes he is required under the Act to brief both committees, and not just the Gang of Eight (see January 4, 2006). The White House claims that it has briefed Congressional leaders about the program over a dozen times, but refuses to provide details; the Congressional members so briefed are forbidden by law to discuss the content or nature of those classified briefings, even with their own staff members. “We believe that Congress was appropriately briefed,” says White House spokeswoman Dana Perino. The CRS agrees with Harman that the single exception to such full briefings under the law, covert actions taken under extraordinary threats to national security, is not applicable in this instance. Unless the White House contends the program is a covert action, the memo says, “limiting congressional notification of the NSA program to the Gang of Eight…would appear to be inconsistent with the law.” [US House of Representatives, 1/4/2006; Congressional Research Service, 1/18/2006 ; Washington Post, 1/19/2006] The day after the CRS memo is released, Senate Democrats John D. Rockefeller (D-WV) and Harry Reid (D-NV), along with House Minority Leader Nancy Pelosi (D-CA) and Harman, the ranking member of the House Intelligence Committee, write to Vice President Dick Cheney demanding that the full committees be briefed on such intelligence matters in the future. [Washington Post, 1/20/2006] On February 9, Bush will allow Attorney General Alberto Gonzales and former NSA chief Michael Hayden to brief the full House Intelligence Committee on the program (see February 8-17, 2006).

In a public speech, former National Security Agency chief Michael Hayden claims that everything the NSA does is with authorization from the White House, specifically the warrantless wiretapping program that spies on US citizens (see Early 2002). “I didn’t craft the authorization,” he says. “I am responding to a lawful order.” Hayden claims that while the NSA continues to use court warrants from the Foreign Intelligence Surveillance Court (FISC), technological advances and terrorist threats have made the law that created and supports FISC, the Foreign Intelligence Surveillance Act of 1978 (see 1978), obsolete. Therefore, the NSA has carried out domestic surveillance operations with or without FISC warrants. Hayden says the warrantless surveillance operations are “operationally more relevant, operationally more effective” than anything FISA can handle. Hayden repeatedly denies, in the face of reams of evidence collected by journalists and others to the contrary, that the NSA is spying on domestic antiwar groups and religious organizations like the Quakers who publicly advocate nonviolence and peace. Deputy Director of National Intelligence and former NSA Director Michael Hayden says that if the NSA’s recently revealed warrantless wiretapping program (see December 15, 2005) had been in place before 9/11, “it is my professional judgment that we would have detected some of the 9/11 al-Qaeda operatives in the United States, and we would have identified them as such.” Hayden will later say the NSA would have detected calls between an al-Qaeda communications hub in Yemen and 9/11 hijackers Nawaf Alhazmi and Khalid Almihdhar in San Diego (see May 18, 2006). Hayden adds: “You know, the 9/11 Commission criticized our ability to link things happening in the United States with things that were happening elsewhere. In that light, there are no communications more important to the safety of this country than those affiliated with al-Qaeda with one end in the United States.” Before the attacks, the NSA intercepted a series of calls between two of the 9/11 hijackers and a known al-Qaeda communications hub in Yemen (see Early 2000-Summer 2001), but failed to notify the FBI about them (see (Spring 2000)). [Press Club, 1/23/2006] Other administration officials make similar claims about the calls by Almihdhar and Alhazmi in the years after the NSA’s warrantless program is revealed by the New York Times (see December 17, 2005).
The White House twice convinces Congressional leaders to derail or water down upcoming Congressional hearings into its warrantless wiretapping program, dodging potentially embarrassing public revelations about its surveillance of US citizens. Some observers praise the Bush administration for accepting more Congressional oversight, but some lawmakers feel the concessions made by the White House in return for Congress’s back down from full hearings mean little. Privately, some Republicans say that the White House came far closer to suffering large public setbacks than is generally known, and that President Bush must be more forthcoming about the warrantless wiretapping program if he wants to retain the good will of Congress. On February 8, a day before the House Intelligence Committee is to begin its hearings on the program, some lawmakers are complaining that the administration is trying to dodge any real discussion of the program; two days before, Attorney General Alberto Gonzales had defended the program without providing any details, and the White House intended to send Gonzales and former NSA head Michael Hayden to the hearings to give the same limited briefing. Instead, the White House agrees to have Gonzales and Hayden provide more details about the program’s “procedural aspects,” the first time a full Congressional committee has received a briefing about the program (see January 4, 2006 and January 18, 2006). Many committee members are placated by the briefing. In return, committee leaders agree to stymie Democrats’ attempts to hold more expansive hearings into the program. On February 17, the Senate Intelligence Committee deals with a motion by ranking Democrat Jay Rockefeller (D-WV) to open a broad inquiry into the program. But White House chief of staff Andrew Card has, two days before, spoken with committee member Olympia Snowe (R-ME). Snowe had expressed her own concerns about the program’s legality, and its infringement on constitutional civil liberties, and she is, according to Senate sources briefed on the call, “taken aback” by Card’s intransigence about restricting Congressional oversight of the program. Snowe and fellow senator Chuck Hagel (R-NE), another Republican who has voiced his own doubts about the program, speak with committee chairman Pat Roberts (R-KS). Roberts thinks he has the votes to defeat Rockefeller’s motion, but he learns Snowe and Hagel will support it, thus ensuring its passage. Thus informed, Roberts blocks passage of the motion by arranging a party-line vote to adjourn the committee until March 9, a move that infuriates Rockefeller. “The White House has applied heavy pressure in recent weeks to prevent the committee from doing its job,” he says after the adjournment. Both Hagel and Snowe deny folding under administration pressure. The White House is supportive of a proposal by Senator Mike DeWine (R-OH) that would exempt the NSA program from FISA, while providing for limited congressional oversight. Retired AT&T technician Mark Klein (see December 15-31, 2005 and July 7, 2009), working with a civil liberties group about his knowledge of governmental illegality in eavesdropping on Americans’ telephone and Internet communications (see Early January 2006), has contacted Los Angeles Times reporter Joseph Menn about publishing an article expising AT&T’s collusion with the National Security Agency (NSA) to illegally conduct surveillance against American citizens (see January 23, 2006 and After). Klein believed Menn was enthusiastic about exposing AT&T and the NSA in his newspaper. Instead, Klein is shocked to hear from Menn that the Times’s “top guy” is preparing to meet with Director of National Intelligence John Negroponte to discuss any such publication. “I nearly fell down in shock,” Klein will later write. “[T]hey were actually negotiating with the government on whether to publish!” Menn describes himself to Klein as “demoralized,” and says the chances of getting the story published are “grim.” In his seven years at the Times, Menn tells Klein, he has never seen a story “spiked” for “nefarious reasons,” implying that the reason behind the story’s non-publication are “nefarious.” Klein is also dismayed that the Times has now revealed his existence as a whistleblower to Negroponte, and by extension to the US intelligence apparatus. Two days ago, Klein began emailing a New York Times reporter, James Risen, the co-author of a 2005 expose about the NSA’s surveillance program (see December 15, 2005). After hearing from Menn, Klein emails Risen to inform him of the Los Angeles Times’s decision to “consult” with Negroponte, and also of the lack of interest he has received from Senator Dianne Feinstein’s office (see February 1-6, 2006). Risen calls in fellow reporter Eric Lichtblau, his co-author on the 2005 story, and the two begin working on their own story. Klein remains worried about his personal and professional safety, since, as he will write, “[t]he government was on to me, but I did not yet have a published article and the protection that comes with publicity. I had visions, perhaps paranoid in hindsight, of being disappeared in the night, like [nuclear industry whistleblower] Karen Silkwood.” The Los Angeles Times story will drag on until March 29, when Menn will inform Klein that it is officially dead, blocked by Times editor Dean Baquet. Klein will later learn that Baquet had not only been in contact with Negroponte, but with NSA Director Michael Hayden. In 2007, Baquet will tell ABC News reporters that “government pressure played no part in my decision not to run with the story,” and will say that he and managing editor Doug Frantz decided “we did not have a story, that we could not figure out what was going on” with Klein’s documentation (see March 26, 2007). Klein will call Baquet’s explanation an “absurd and flimsy excuse,” and will say it is obvious that the Los Angeles Times “capitulated to government pressure.” [PBS Frontline, 5/15/2007; Klein, 2009, pp. 59-62]

[Source: ABC News]According to an ABC News report in September 2007, CIA Director Michael Hayden bans the use of waterboarding some time in 2006, with the approval of the White House. It is not known when exactly the technique is banned that year, but presumably it takes place after Hayden becomes CIA director (see May 5, 2006) and in response to the Supreme Court decision mandating that terror suspects must be given treatment consistent with the Geneva Conventions (see July 12, 2006). Waterboarding is a harsh interrogation technique that simulates drowning and is usually referred to as torture. Allegedly, the CIA last used waterboarding in 2003 on Khalid Shaikh Mohammed and “It is believed that waterboarding was used on fewer than five ‘high-value’ terrorist subjects” (see May 2002-2003). John Sifton of Human Rights Watch later says the ban “a good thing, but the fact remains that the entire [CIA interrogation] program is illegal.” [ABC News, 9/14/2007] Over a year before Hayden’s decision, Justice Department official Daniel Levin had himself subjected to simulated waterboarding to help him determine if waterboarding was indeed torture (see Late 2004-Early 2005). Levin intended to issue a memo condemning the practice as beyond the bounds of the law, but was forced out of the Justice Department before he could make that ruling.

CIA Director Porter Goss abruptly resigns “amid allegations that he and a top aide may have attended Watergate poker parties where bribes and prostitutes were provided to a corrupt congressman.” A senior law enforcement official says, “It’s all about the Duke Cunningham scandal.” Congressman Randall “Duke” Cunningham (R-CA) was sentenced to eight years in prison after pleading guilty in late 2005 to taking millions of dollars in bribes. Goss is replaced by General Michael Hayden, the former director of the NSA. [New York Daily News, 5/6/2006] The Bush administration gives no explanation for the resignation and even Goss publicly describes his own resignation as “just one of those mysteries.” [CNN, 5/6/2006] It is later learned that Goss’s resignation is spurred in part because of the controversy surrounding his chosen CIA Executive Director, Kyle “Dusty” Foggo. Foggo is being investigated for his connections to Cunningham. Both Foggo and Cunningham are being investigated by the office of US Attorney Carol Lam (see November 8, 2002). [Talking Points Memo, 2011] In 2007, former senior CIA analyst Valerie Plame Wilson will write: “Once John Negroponte became the de facto intelligence czar as director of national intelligence (DNI—see February 17, 2005)… Goss’s effectiveness, prestige, and daily access to the president had been considerably diminished. This, in turn, further degraded and undermined the organization he led. During a time of driving massive change, which Goss and other senior intelligence managers were attempting to do at the agency, effective and clear communication with all levels of the organization is critical. Goss failed completely at this task and the cost was high.… [H]e had been a poor fit from the beginning. In an underperforming bureaucracy such as the CIA, a strong leader, respected by the rank and file, is essential to managing needed change and modernization. On a personal note, I was not sorry to see him go.” [Wilson, 2007, pp. 247-248]
Former NSA Director Michael Hayden, testifying as part of his nomination hearings to head the CIA, denies that the NSA has engaged in illegal surveillance operations against US citizens, after allegations by former Qwest CEO Joe Nacchio that he met with NSA officials well before the 9/11 attacks and discussed such a surveillance program. Nacchio refused to cooperate with the NSA, and he says that his telecommunications firm suffered retaliation as a result of his refusal (see February 27, 2001). Other telecom firms such as BellSouth, AT&T, and Verizon did cooperate (see February 2001 and Beyond). Court documents show that Nacchio balked at cooperating with the NSA after learning that the agency wanted Qwest’s phone records of the firm’s customers, but had no warrants or approval from the Foreign Intelligence Surveillance Court, which oversees all US intelligence agencies’ surveillance operations.
Denial - Hayden denies that the NSA has broken the law, and that it has complied with its oversight responsibilities. “Everything that the agency has done has been lawful,” he says. “It’s been briefed to the appropriate members of Congress. The only purpose of the agency’s activities is to preserve the security and the liberty of the American people. And I think we’ve done that.” Nacchio says the NSA continued to make similar requests of Qwest until he left the firm in June 2002. The court documents are part of Nacchio’s trial on numerous counts of insider trading.
Political Reaction - The White House and Senate Republicans are generally supportive of Hayden while Senate Democrats have mixed feelings. One who questions Hayden’s credibility is Ron Wyden (D-OR) of the Senate Intelligence Committee, who says, “The American people have got to know that when the person who heads the CIA makes a statement that they are getting the full picture.” In contrast, Kit Bond (R-MO), a member of the select panel allowed access to classified information on the warrantless surveillance program, says, “The president’s program uses information collected from phone companies,” but only the telephone number called and the caller’s number. Conversations, says Bond, are not recorded. President Bush says that the NSA wiretapping program is not “mining or trolling through the personal lives of millions of innocent Americans.”
Scope of Program - A senior government official given permission to speak anonymously about the program says that while the NSA has access to records of almost all domestic phone calls, the records are used solely to trace regular contacts of “known bad guys.” The NSA needs access to the entirety of citizens’ phone communications, the official says, but it isn’t “interested in the vast majority of them.” [Associated Press, 5/12/2006; New York Times, 5/12/2006; CBS News, 5/12/2006]

Two public interest lawyers sue Verizon Communications for $5 billion, claiming the telecommunications firm violated privacy laws by giving the phone records of its customers to the NSA for that agency’s secret, warrantless domestic surveillance program. Lawyers Bruce Afran and Carl Mayer are asking that Verizon stop turning over its records to the NSA without either a court order or the consent of the customer. Afran says of the NSA program, “This is the largest and most vast intrusion of civil liberties we’ve ever seen in the United States.” [CBS News, 5/12/2006] Days later, AT&T and BellSouth are added to the lawsuit. [CNN, 5/17/2006]
Verizon Helped Build an NSA Database? - The day before, the press reports that the NSA has built a database of millions of domestic phone records since shortly after the 9/11 attacks, using records from Verizon, BellSouth, and AT&T (see May 11, 2006). Former Qwest CEO Joe Nacchio, whose firm refused to cooperate with the NSA, says that he was approached months before the attacks to help set up such a program (see February 27, 2001). The NSA has the power, under President Bush’s interpretation of his wartime authority, to have the agency eavesdrop on international calls made to or from the US, but cannot legally eavesdrop on internal calls unless it has a court order. The lawsuit claims that the telecoms violated the Constitution and the Telecommunications Act by giving its records to the government without court authorization. The lawsuit seeks $1,000 for each violation of the Telecommunications Act, or $5 billion if the case is certified as a class-action suit. The lawyers are seeking documents detailing the origins of the NSA program, as well as Bush’s own role in authorizing the program. “Federal law prohibits the phone companies from giving records to the government without a warrant,” says Afran. “There was no warrant, nor was there any attempt to get warrants, which is in violation of the constitution and the Telecommunications Act.” [CBS News, 5/12/2006; CNET News, 5/15/2006] Afran says, “One of the purposes of this case is to, quite frankly, hold the threat of financial destruction over the heads of the phone companies to make them abandon this policy of cooperating with warrantless searches by the government.” [National Public Radio, 5/17/2006] The lawsuit alleges that Verizon constructed a dedicated fiber optic line from New Jersey to a large military base in Quantico, Virginia, that allowed government officials to gain access to all communications flowing through the carrier’s operations center. A former consultant who worked on internal security will later say he had tried numerous times to install safeguards on the line to prevent hacking on the system, as he was doing for other lines at the operations center, but he was prevented from doing so by a senior security official. One of the allegations against Verizon in the lawsuit is made by Philadelphia resident Norman LeBoon, who says after he read of the alleged surveillance of US citizens, he began asking Verizon if his landline communications were being shared. LeBoon says he eventually spoke with “Ellen” in Verizon customer service, who told him, “I can tell you, Mr. LeBoon, that your records have been shared with the government, but that’s between you and me.… They [Verizon] are going to deny it because of national security. The government is denying it and we have to deny it, too. Around here we are saying that Verizon has ‘plausible deniability.’” [Truthdig, 8/9/2007]
AT&T Grants Unlimited Access? - The lawsuit claims that in February 2001, days before Qwest was approached, NSA officials met with AT&T officials to discuss replicating an AT&t network center to give the agency access to all the global phone and e-mail traffic that ran through it (see February 2001).
Earlier Reporting Made Key Error - Earlier reporting of the NSA’s cooperation with the telecoms got a key detail wrong, says telecom analyst Scott Cleland: “What I think people got wrong with the original reporting, was that this was local phone companies tracking local phone calls. What is clear now is they were tracking long distance calls.” [National Public Radio, 5/17/2006]
Almost two years after resigning from the CIA (see Early November, 2004), Stephen Kappes agrees to return as deputy director for the new agency head, General Michael Hayden. Kappes is leaving his position as the chief operating officer for ArmorGroup International, a British security firm, to take the position. He is a former Marine with 25 years of service in the CIA. He is fluent in Russian and Farsi, and took part in agency operations against Iran while serving in the Frankfurt, Germany, station. After the 1991 Gulf War, Kappes reopened the CIA’s Kuwait station. He also was a key participant in the agency’s attempts to find information on nuclear black marketeer A. Q. Khan. He was deputy director for operations under former CIA chief George Tenet before coming into conflict with Tenet’s replacement, Porter Goss (see September 24, 2004). Kappes was one of the first of many CIA officials to leave the agency under Goss’s tenure, either by resignation or by firing as Goss attempted to purge the agency of all but Bush administration loyalists (see November-December 2004). [New York Times, 5/30/2006; Time, 6/1/2006] In May, CNN reported that Kappes was being offered the job in part to assuage concerns among members of the Senate Intelligence Committee, who doubt Hayden’s ability to lead the agency and question whether he will run it in a nonpartisan fashion. Many observers see Kappes’s return both as a repudiation of Goss, who abruptly resigned over allegations of involvement with prostitutes and bribery schemes (see May 5, 2006), and as a potential brake on any possible instances of Hayden putting his loyalty to the Bush administration over his loyalties to the CIA and the nation. John Negroponte, the director of national intelligence, said when Kappes’s nomination for the position was announced: “I believe that Mike’s appointment, and I think together if the appointment of Steve Kappes goes through, I think that’s going to be a boost for the morale out there. And I think they’re going to welcome this new leadership.” Hayden himself has said that Kappes’s return is a signal that “amateur hour” is over. Former clandestine CIA agent Milt Bearden says, “The simple fact is that he is a very solid choice to come to the agency at a time when it is extremely wobbly.” And a former top CIA official says: “The really good people are happy he’s coming back. The ones who are scared of him should be scared of him.” [CNN, 5/9/2006; New York Times, 5/30/2006]
Osama bin Laden is again rumored to be dead. The rumor is first sparked by the French newspaper L’Est Republicain, which publishes what it describes as a confidential document from the French intelligence service Direction Générale de la Sécurité Extérieure saying that bin Laden died of typhoid on August 23. The report is apparently based on information from Saudi Arabian intelligence. The issue becomes, as Time magazine puts it, “the question of the day,” but the accuracy of the report is questioned by French President Jacques Chirac, Saudi Ambassador to the US Prince Turki al-Faisal, CIA Director Michael Hayden, and others, who all tell the media they think bin Laden may still be alive. Russian President Vladimir Putin, however, remarks that leaks can be used for manipulation, saying, “When there are leaks… one can say that [they] were done especially.” [Time, 9/23/2006; MSNBC, 9/24/2006] Another video of bin Laden footage will be released a week later (see September 30, 2006), apparently by the US. A rumor of bin Laden’s death also preceded an audiotape released earlier in the year (see January 16, 2006, January 19, 2006, and January 19, 2006).
Speaking publicly before a Congressional committee, CIA Director Michael Hayden says that “the lessons learned in Iraq are being applied to Afghanistan” by al-Qaeda. For instance, the number of suicide bombings in Afghanistan is greatly increasing (see 2004-2007). [Rashid, 2008, pp. 282, 442] The Taliban also greatly increase the use of IEDs (improvised explosive devices), the roadside bombs which have proven highly effective in Iraq. The use of IED bombings rises from 530 times in 2005 to 1,297 in 2006. [Rashid, 2008, pp. 367]
The Director of the Central Intelligence Agency, General Michael V. Hayden, appearing before a hearing of the Senate Armed Services Committee to address the current situation in Iraq and Afghanistan, states that the Afghan government’s outreach and provision of security to the country is inadequate. Hayden stresses that the key to making progress in Afghanistan is bolstering security, stating, “The capacity of the government needs to be strengthened to deliver basic services to the population—especially security.” He notes that there are not enough properly trained, equipped, or well-paid security forces in Afghanistan. “Even though the Afghan National Army continues to become larger, stronger, and more experienced, progress has been slow and little progress has been made in constructing an effective Afghan National Police force,” reads his prepared statement. [Senate Armed Services Committee, 11/15/2006 ]
The US intelligence community begins plumbing the data they have compiled on Iran’s nuclear weapons program in an attempt to shore up the Bush administration’s premature conclusion that Iran is on the verge of producing a nuclear weapon. Instead, their conclusions are that Iran shut down its nuclear weapons program in 2003. In the process, White House aides begin a program of “deep dives,” or special briefings for President Bush to meet with not only his advisers but the actual analysts who study Iranian intelligence data, in an attempt to allow Bush to “get his hands dirty” with real intelligence and not just pre-digested summaries. Bush is dismayed at the lack of solid intelligence on Iran’s nuclear program and asks for more. When the intelligence community does provide more, it finds more and more evidence that Iran had shut down its nuclear weapons program years before. Those conclusions will be released in a National Intelligence Estimate (NIE) a year later (see December 3, 2007).
Troubling Conclusions, White House Spin - Bush and his top officials don’t like the findings; if true, the reports disprove the entirety of the administration’s push to define Iran as an imminent threat to the Middle East. White House officials are initially skeptical, believing that the intelligence community might be a victim of Iranian disinformation. The intelligence agencies create a special “red team” of analysts to thoroughly test and, if possible, discredit the information. They are unable to do so. “They tried to figure out what exactly it would take to perpetrate that kind of deception, how many people would be involved, how they would go about doing it, when it would have been set up and so forth,” says one intelligence official. Analysts “scrubbed and rescrubbed” more than 1,000 pieces of evidence but conclude Iran’s program really had been shut down. Faced with that conclusion, the White House decides to focus on the findings that confirm their suspicions—that Iran did have a secret weapons program that could be restarted again. No one in the White House suggests that Bush tone down his rhetoric or change his policies towards Iran. Director of National Intelligence Mike McConnell decides to keep the new findings secret, the same position adopted by Vice President Cheney (see October 2006 and November 10, 2007). Only the Israelis are told of the new findings; Congress, the US’s European allies, and the UN’s monitoring agency, the International Atomic Energy Agency (IAEA) are told nothing. McConnell will reluctantly change his mind out of a fear of leaks and possible charges of a coverup. That decision may come back to haunt the administration, particularly with the ill-will it will create among the US’s allies. Former State Department nonproliferation official Robert Einhorn says, “The administration is going to pay a price for not allowing allies in on it at an earlier date. The French had carried the administration’s water on this issue and really went out on a limb to get the European Union to adopt tough sanctions. And now the rug has been pulled out from under them.”
New NIE Draft Sparks Controversy - An NIE the year before (see August 2, 2005) had led the US to conclude that Iran was actively working on a nuclear weapons program. Congressional Democrats, not entirely convinced by the NIE’s conclusions and increasingly resistant to Bush’s push for confrontation with Iran, asks for a new NIE. Bush wants the new NIE to confirm his accusations and, in one official’s words, “get more information on Iran so we know what they’re up to.” The 2005 NIE had been based largely on information about Iran’s “Project 1-11,” a program that Iran is apparently pursuing to retrofit a ballistic missile to carry nuclear warheads (see Summer 2004). But no new information on Project 1-11 has been secured in three years, and the administration insists on new confirmations. “They just wouldn’t budge,” one agency official recalls. A new draft is completed in June, provoking heated discussions among agency and administration officials. CIA director Michael Hayden and NSA director Keith Alexander begin directing their agencies to closely monitor Iranians who were involved in their country’s nuclear program. Soon, communications intercepts from key Iranian officials indicate that the program had been mothballed in 2003. Some of the officials discuss their belief that the program may never be restarted.
Evolving NIE - As the draft NIE evolves, McConnell, with the assistance of his deputies Thomas Fingar and Donald Kerr, both national security veterans, lay down ground rules. One official later says that McConnell “quickly got the mantra down: ‘We must make a clear distinction between what we know and don’t know and what we judge to be the case.’” The internal debate over the NIE is sharp and often contentious. McConnell will finally inform Bush of the new conclusions—that Iran stopped its nuclear weapons program in 2003—in August (see December 5, 2007 and December 3-4, 2007). In September, House and Senate intelligence committee members are informed as well. A September draft radically differs from the June version, based in large part on the communications intercepts and the exhaustive analysis on the data possessed by the CIA and NIE. The chief analysts are grilled by Hayden and his deputy Stephen Kappes, but the analyses stand up. Cheney, National Security Adviser Stephen Hadley, and other key officials will be given a preliminary briefing on the new NIE on November 15; Bush, finalizing a Middle East peace conference in which he will try to rally Middle Eastern countries against Iran, is not officially told of the new NIE until November 28. President George W. Bush adopts more confrontational language with regard to Iran and alleges that Iran is working against US interests in Iraq. In an address to the nation, he says, “We will seek out and destroy the networks providing advanced weaponry and training to our enemies in Iraq.” The president announces the decision to send another strike group of ships (i.e., an aircraft carrier and companion ships) to the Persian Gulf. Patriot missiles will also be sent to the region for the security of US allies there, he says. [US President, 1/15/2007 ] According to an article published in the New York Times the next day, US officials hold that these actions are not indicative of a coming attack on Iran. However, the same officials say that members of the administration, such as Secretary of State Condoleezza Rice and National Security Adviser Stephen J. Hadley, have determined that the United States is finished with diplomatic attempts to deal with Iran, unless Iran makes a significant change in its behavior. Bush and other US officials claim that Iran, particularly the Revolutionary Guard’s Quds force, has helped train Iraqi Shiite militias how to attack US troops in Iraq. Military officials believe that “shaped charges,” a type of roadside bomb that has been increasingly used against troops, are made in Iran. General Michael V. Hayden, CIA Director, recently told Congress that he has the “zeal of a convert” and now strongly believes that Iran is contributing to the death toll of US soldiers in Iraq. [Source: US House of Representatives]In response to a question asked at a briefing, CIA Director Michael Hayden makes an “offhand comment” to the House Intelligence Committee indicating that tapes the CIA has made of detainee interrogations have been destroyed (see Spring-Late 2002). Although some committee members have been aware of the tapes’ existence since 2003 (see February 2003), this is apparently the first time they learn of their destruction, which occurred over year ago (see November 2005). The destruction is again “briefly mentioned” in a letter to a member of the committee in mid-April. Leading committee members Silvestre Reyes and Peter Hoekstra will later write to Hayden, “We do not consider this to be sufficient notification. Moreover, these brief mentions were certainly not contemporaneous with the decision to destroy the videotapes.” [US Congress, 12/7/2007] The Senate Intelligence Committee is apparently not informed until later (see December 7, 2007).
Valerie Plame Wilson testifies before the House Oversight Committee. [Source: Life]The House Oversight Committee holds a hearing about the ramifications of the Lewis Libby guilty verdict (see March 6, 2007) and the outing of former covert CIA agent Valerie Plame Wilson (see July 14, 2003). Plame Wilson is the star witness, and for the first time publicly discusses the leak and her former status as a covert agent. As earlier revealed by authors Michael Isikoff and David Corn in their book Hubris, Plame Wilson was the covert operations chief for the Joint Task Force on Iraq (JTFI), a section of the CIA’s Counterproliferation Division (CPD), which itself is part of the agency’s clandestine operations directorate. Indeed, as Libby special prosecutor Patrick Fitzgerald has already stated, the fact of her employment with the CIA was itself classified information (see October 28, 2005). Republican Attempts to Close Hearing Fail - Tom Davis (R-VA), the committee’s ranking Republican, attempts to close Plame Wilson’s testimony to the public on the grounds that her statements might threaten national security. “It would be with great reluctance, but we have to protect confidential information,” he says. Politico reporter John Bresnahan describes Davis as “clearly unhappy that the hearing is taking place at all, so his threat has to be viewed in that context.” Davis goes on to say: “We are mining something that has been thoroughly looked into. There are so many other areas where [Congressional] oversight needs to be conducted instead of the Plame thing.” The hearing will remain open to the public. [Politico, 3/14/2007]
Pre-Testimony Jitters - In her book Fair Game, Plame Wilson recalls the jitters she experiences in the hours leading up to her appearance before the committee. She had tried, in the days before the hearing, “to think of every possible question the committee could throw at me.… I had to be sharp to avoid giving any information that the CIA would deem sensitive or classified. It was a minefield.” She is relieved to learn that CIA Director Michael Hayden has met with committee staffers and, she will write, “explicitly approved the use of the term ‘covert’ in describing my cover status.” She will write that though she still cannot confirm the length of her service with the CIA, she can “at least counter those who had suggested over the last few years that I was no more than a ‘glorified secretary’” (see Fall 1985, Fall 1989, Fall 1992 - 1996, and April 2001 and After). CIA Confirmed Plame Wilson's Covert Status - Before Plame Wilson testifies, committee chairman Henry Waxman (D-CA) reads a statement saying that she had been a “covert” officer” who had “served at various times overseas” and “worked on the prevention of the development and use of weapons of mass destruction against the United States.” Waxman notes that the CIA had cleared this statement. And during subsequent questioning, committee member Elijah Cummings (D-MD) reports that Hayden had told him, “Ms. Wilson was covert.” [Nation, 3/16/2007; Think Progress, 3/16/2007; FireDogLake, 3/16/2007; Christy Hardin Smith, 3/16/2007]
Confirms Her Status in CPD - Plame Wilson testifies that she is still bound by secrecy oaths and cannot reveal many of the specifics of her CIA career. However, she testifies, “I served the United States of America loyally and to the best of my ability as a covert operations officer for the Central Intelligence Agency.” She says, “In the run-up to the war with Iraq, I worked in the Counterproliferation Division of the CIA, still as a covert officer whose affiliation with the CIA was classified.” She also notes that she helped to “manage and run secret worldwide operations.” Prior to the Iraq war, she testifies, she had “raced to discover intelligence” on Iraq’s weapons of mass destruction. “While I helped to manage and run secret worldwide operations against this WMD target from CIA headquarters in Washington, I also traveled to foreign countries on secret missions to find vital intelligence.” Those trips had occurred within the last five years, she says, contradicting arguments that she had not functioned as a covert agent within the last five years and therefore those who revealed her identity could not be held legally accountable (see February 18, 2007). “Covert operations officers, when they rotate back for temporary assignment in Washington, are still covert,” she says. Furthermore, far from her identity as a CIA agent being “common knowledge on the Georgetown cocktail circuit,” as some have alleged (see September 30, 2003, July 12, 2004, and March 16, 2007), she testifies that she can “count on one hand” the number of people outside the agency who knew of her CIA status before her outing by White House officials. “But, all of my efforts on behalf of the national security of the United States, all of my training, and all of the value of my years service were abruptly ended when my name and identity were exposed irresponsibly.” [Wilson, 2007, pp. 300-302; Nation, 3/16/2007; Mother Jones, 3/16/2007] During this portion of testimony, Davis repeats an assertion that neither President Bush nor Vice President Dick Cheney were aware of Plame Wilson’s covert status during the time of her exposure. 'They Should Have Been Diligent in Protecting Me and Other CIA Officers' - Plame Wilson testifies that, as the Libby trial progressed, she was “shocked and dismayed by the evidence that emerged. My name and identity were carelessly and recklessly abused by senior government officials in both the White House and the State Department. All of them understood that I worked for the CIA, and having signed oaths to protect national security secrets, they should have been diligent in protecting me and every CIA officer.” Many agents in CPD are covert, she says, and thusly, officials such as Cheney and Libby, who knew she worked in that division, should have been careful in spreading information about her.
'Grave' Damage to National Security - Plame Wilson says she cannot be specific about what kind of damage was done by her identity being revealed (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, October 29, 2005, and February 13, 2006); the CIA did perform a damage assessment, but did not share the results with her, and that assessment is classified (see Before September 16, 2003). “But the concept is obvious,” she says. “Not only have breaches of national security endangered CIA officers, it has jeopardized and even destroyed entire networks of foreign agents who in turn risked their own lives and those of their families—to provide the United States with needed intelligence. Lives are literally at stake. Every single one of my former CIA colleagues, from my fellow covert officers, to analysts, to technical operations officers, to even the secretaries, understands the vulnerability of our officers and recognizes that the travesty of what happened to me, could happen to them. We in the CIA always know that we might be exposed and threatened by foreign enemies. It was a terrible irony that administration officials were the ones who destroyed my cover… for purely political motives.” [Wilson, 2007, pp. 300-302; Nation, 3/16/2007] She refuses to speculate as to the intentions of White House deputy chief of staff Karl Rove in exposing her identity (see July 10, 2005). Politicization of Intelligence Dangerous, Counterproductive - Plame Wilson decries the increasingly partisan politicization of intelligence gathering and presentation under the Bush regime, saying: “The tradecraft of intelligence is not a product of speculation. I feel passionately as an intelligence professional about the creeping, insidious politicizing of our intelligence process. All intelligence professionals are dedicated to the ideal that they would rather be fired on the spot than distort the facts to fit a political view—any political view—or any ideology.… [I]njecting partisanship or ideology into the equation makes effective and accurate intelligence that much more difficult to develop. Politics and ideology must be stripped completely from our intelligence services, or the consequences will be even more severe than they have been and our country placed in even greater danger. It is imperative for any president to be able to make decisions based on intelligence that is unbiased.” [Wilson, 2007, pp. 300-302; Nation, 3/16/2007]
No Role in Deciding to Send Husband to Niger - Plame Wilson discusses the persistent rumors that she dispatched her husband, former ambassador Joseph Wilson, to Niger to investigate claims that Iraq had attempted to purchase uranium from that country (see February 21, 2002-March 4, 2002). Such rumors imply that Wilson was unqualified for the mission, and was sent by his wife for reasons having to do with partisan politics and nepotism (see July 9, 2004). Plame Wilson testifies that she had no authority to send her husband anywhere under CIA auspices, that it was a co-worker’s suggestion, not hers, to send her husband (see February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005), and that her participation was limited to writing a note outlining her husband’s qualifications for such a fact-finding mission (see Fall 1999 and February 13, 2002). She testifies that a colleague had been misquoted in an earlier Senate Intelligence Committee report in saying that she proposed her husband for the trip, and that this colleague was not permitted to correct the record. Further Investigation Warranted - After Plame Wilson concludes her testimony, Waxman declares: “We need an investigation. This is not about Scooter Libby and not just about Valerie Plame Wilson.” Journalist David Corn concurs: “Waxman was right in that the Libby trial did not answer all the questions about the leak affair, especially those about the roles of Bush administration officials other than Libby. How did Cheney learn of Valerie Wilson’s employment at the Counterproliferation Division and what did he do with that information? How did Karl Rove learn of her CIA connection? How did Rove manage to keep his job after the White House declared anyone involved in the leak would be fired?… What did Bush know about Cheney’s and Rove’s actions? What did Bush do in response to the disclosure that Rove had leaked and had falsely claimed to White House press secretary Scott McClellan that he wasn’t involved in the leak?” Republican committee members are less sanguine about the prospect of such an investigation, with Davis noting that special prosecutor Patrick Fitzgerald had already conducted an investigation of the leak. Corn writes: “Not all wrongdoing in Washington is criminal. Valerie Wilson’s presence at the hearing was a reminder that White House officials (beyond Libby) engaged in improper conduct (which possibly threatened national security) and lied about it—while their comrades in the commentariat spinned away to distort the public debate.” [Nation, 3/16/2007; Nation, 3/19/2007]

Former Los Angeles Times editor Dean Baquet says his newspaper did not bow to government pressure in choosing not to run a story about allegations by AT&T whistleblower Mark Klein (see July 7, 2009, December 15-31, 2005, and February 11, 2006 and After). In an ABC News report on Klein’s allegations of AT&T’s complicity with the National Security Agency (NSA) to illegally conduct warrantless electronic surveillance against American citizens, Klein says that the Times bowed to government pressure from the then-Director of National Intelligence John Negroponte and the then-Director of the NSA Michael Hayden. Baquet, now the Washington bureau chief of the New York Times, says that while he spoke to both Negroponte and Hayden about the story, “government pressure played no role in my decision not to run the story.” Instead, Baquet says he and managing editor Doug Frantz decided “we did not have a story, that we could not figure out what was going on” based on Klein’s highly technical documents. Baquet says Times reporter Joseph Menn disagreed with his decision, “and was very disappointed.” Klein’s story was published in the New York Times in April 2006 (see April 7, 2006 and April 12, 2006). [ABC News, 3/26/2007] Klein will later write that Baquet’s explanation is an “absurd and flimsy excuse,” and will say it is obvious that the Los Angeles Times “capitulated to government pressure.” [Klein, 2009, pp. 62]

[Source: Flickr.com]Four senators—Russell Feingold (D-WI), Dianne Feinstein (D-CA), Chuck Hagel (R-NE), and Ron Wyden (D-OR)—send letters objecting to the CIA’s use of waterboarding and other extreme methods of interrogation against terrorism suspects after receiving a briefing from CIA Director Michael Hayden on the subject. Though lawmakers are bound by secrecy oaths from revealing the nature of the classified briefings on secret interrogation subjects, in November 2007, Feingold will breach that oath, complaining that the Bush administration is mischaracterizing the level of Congressional support for what administration officials call “enhanced interrogation tactics” (see November 7, 2007). [Washington Post, 12/9/2007]
In October 2007, the New York Times will report that in July, “after a month-long debate inside the administration, President Bush signed a new executive order authorizing the use of what the administration calls ‘enhanced’ interrogation techniques—the details remain secret—and officials say the CIA again is holding prisoners in ‘black sites’ overseas.” The executive order is said to have been reviewed and approved by Steven Bradbury, head of the Office of Legal Counsel. [New York Times, 10/4/2007] In late 2005 the Justice Department issued a secret memo declaring all aggressive interrogation techniques used by the CIA legal (see Late 2005), so apparently this mostly reconfirms the gist of that earlier ruling. It has been clear since April 2007 that the secret CIA prisons are still operating (see Autumn 2006-Late April 2007). Hours after the new executive order is issued, CIA Director Michael Hayden issues a secret memo to his CIA employees: “The President’s action - along with the Military Commissions Act of 2006 - gives us the legal clarity we have sought. It gives our officers the assurance that they may conduct their essential work in keeping with the laws of the United States.” One senior Bush administration official will later hint that the order does allow sleep deprivation to be used but does not allow exposure to extremes of hot and cold. [MSNBC, 9/13/2007] Intelligence officials also later say that the order not to allow the use of waterboarding. [New York Times, 12/7/2007]
President Bush signs Executive Order 13440, which authorizes the CIA to continue using so-called “harsh” interrogation methods against anyone in US custody suspected of being a terrorist, or having knowledge of terrorist activities. The order relies on, and reaffirms, Bush’s classification of “al-Qaeda, Taliban, and associated forces” as “unlawful enemy combatants” who are not covered under the Geneva Conventions. The order also emphasizes that the Military Commissions Act (MCA) (see October 17, 2006) “reaffirms and reinforces the authority of the president to interpret the meaning and application of the Geneva Conventions.” The order does not include “murder, torture, cruel or inhuman treatment, mutilation or maiming, intentionally causing serious bodily injury, rape, sexual assault or abuse, taking of hostages, or performing of biological experiments… other acts of violence serious enough to be considered comparable to murder, torture, mutilation, and cruel or inhuman treatment… any other acts of cruel, inhuman, or degrading treatment or punishment prohibited” by law. It also precludes acts of extreme humiliation “that any reasonable person, considering the circumstances, would deem the acts to be beyond the bounds of human decency, such as sexual or sexually indecent acts undertaken for the purpose of humiliation, forcing the individual to perform sexual acts or to pose sexually, [or] threatening the individual with sexual mutilation, or using the individual as a human shield.” The order also excludes acts that denigrate a detainee’s religion or religious practices. [White House, 7/20/2007] The order does not apply to the Army, which has numerous interrogators operating at Guantanamo and other US detention facilities. [Social Science Research Network, 3/18/2008] CIA Director Michael Hayden says, “We can now focus on our vital work, confident that our mission and authorities are clearly defined.” Administration officials say that because of the order, suspects now in US custody can be moved immediately into the “enhanced interrogation” program. Civil libertarians and human rights advocates are much less enamored of the new order. Human Rights Watch official Tom Malinowski says, “All the order really does is to have the president say, ‘Everything in that other document that I’m not showing you is legal—trust me.’” [Washington Post, 7/21/2007] In January 2009, President Obama will withdraw the order. CIA Director Michael Hayden releases a statement attacking the publication of the executive summary of a report by the CIA’s inspector general about some aspects of the agency’s performance before 9/11 (see August 21, 2007). Hayden lambasts the decision to publish it, saying it will “distract officers serving their country on the frontlines of a global conflict,” “consume time and attention revisiting ground that is already well plowed,” and have a “chilling effect” on officers. Hayden also says that the officers criticized in the report and others “took strong exception to its focus, methodology, and conclusions,” and that neither he nor his predecessor Porter Goss implemented the report’s main finding (see October 10, 2005)—accountability boards to assess the performance of the officers who performed poorly before 9/11. Instead, Hayden praises these officers, saying they “worked flat out” and that their “skill, wisdom, energy, and leadership” made “powerful contributions to our national security.” Despite refusing to convene the accountability boards or even name most of the employees who performed poorly, Hayden remarks, “This is not about avoiding responsibility,” arguing that the CIA has already discussed failings in some of its programs before 9/11. Following the release of a new video and a new audio message from a man thought to be Osama bin Laden (see September 7, 2007 and September 11, 2007), terrorism analyst Peter Bergen says it may be a good idea to allow As-Sahab, a clandestine institute that makes videos for al-Qaeda, to continue to operate. Bergen says it would be difficult to shut the operation down, “You’d have to capture or kill everyone involved, and if you knew who they were, you might want to follow them instead,” says Bergen, adding, “Understanding the inner workings of As-Sahab is probably as good a way as any I can think of to get close to bin Laden and [al-Qaeda deputy leader Ayman al-]Zawahiri.” However, former director of the National Counter-Terrorism Center John Brennan says of a possible attempt at penetrating As-Sahab, “Don’t presume that’s not happening.” CIA Director General Michael Hayden says of As-Sahab’s ability to continue putting out videos, “It might be disappointing, but it shouldn’t be surprising.” [United Press International, 9/19/2007]
CIA Director Michael Hayden orders an unusual internal investigation of the agency’s Office of the Inspector General (OIG), the press will later learn. The OIG, led by Inspector General John Helgerson, has conducted aggressive investigations of the CIA’s detention and interrogation programs (see May 7, 2004). Current and former government officials say that Hayden’s probe has created anxiety and anger in the OIG, and has sparked questions in Congress of possible conflicts of interest. The review is focusing on complaints that the OIG has not been, as the New York Times reports, a “fair and impartial judge of agency operations,” but instead has “begun a crusade against those who have participated in controversial detention programs.” Some current and former officials say that such a probe threatens to undermine the independence of the office. Former CIA Inspector General Frederick Hitz, who served from 1990 through 1998, says any move by Hayden to conduct a probe into the OIG would “not be proper.” Hitz calls it “a terrible idea,” and adds: “Under the statute, the inspector general has the right to investigate the director. How can you do that and have the director turn around and investigate the IG?” A CIA spokesman says Hayden’s only motive is “to help this office, like any office at the agency, do its vital work even better.” The investigation is being overseen by Robert Deitz, a trusted aide to Hayden who served with him when he ran the National Security Agency. Another member of the investigating group is Associate Deputy Director Michael Morrell. Under the law, the proper procedure for Hayden would be to file complaints with the Integrity Committee of the President’s Council on Integrity and Efficiency, which oversees all the inspectors general, or to go directly to the White House. For an internal inquiry to be launched against an agency’s OIG by the agency head violates the independence and the position of the OIG. Critics say that the timing of Hayden’s investigation is more than coincidental, as Helgerson’s office is readying a number of reports on CIA detention, interrogation, and rendition practices. In a statement released by CIA Director Michael Hayden, the CIA admits that it has destroyed videotapes of interrogations of two detainees, Abu Zubaida and Abd al-Rahim al-Nashiri (see Spring-Late 2002 and November 2005). [Central Intelligence Agency, 12/6/2007] The statement is apparently released to preempt a New York Times article on the verge of publication that would have revealed the destruction. [Washington Post, 12/7/2007] The fact that the CIA had videoed detainee interrogations was made public a few weeks previously (see November 13, 2007). [US District Court for the Eastern District of Virginia, Alexandria Division, 10/25/2007 ] According to several former intelligence officials, there is concern that the tapes could have set off controversies about the legality of the interrogations and generated a backlash in the Middle East. [New York Times, 12/8/2007] Numerous political figures condemn the destruction in strong terms. For example, Senator Edward Kennedy (D-MA) says, “We haven’t seen anything like this since the 18½-minute gap in the tapes of President Richard Nixon,” and, “What would cause the CIA to take this action? The answer is obvious—coverup.” Senator Richard Durbin (D-IL) says, “What is at stake here goes to the heart of the rule of law and justice in America.” Human rights activists are also angry, and an Amnesty International spokesman says, “It falls into a pattern of measures that have been taken that obstruct accountability for human rights violations.” [CBS News, 12/7/2007; ABC News, 12/7/2007] Both the Justice Department and the CIA’s Inspector General initiate preliminary inquiries. The House and Senate intelligence committees also start investigations. [Los Angeles Times, 12/9/2007]
Chairman of the Senate Intelligence Committee Jay Rockefeller (D-WV) says that he did not know about the destruction of CIA videos of detainee interrogations (see November 2005 and December 6, 2007). [US Congress, 12/7/2007] This contradicts a statement by CIA Director Michael Hayden saying that, “Our oversight committees also have been told that the videos were, in fact, destroyed.” [Central Intelligence Agency, 12/6/2007] The CIA says that the committee was informed of the destruction in November 2006, but, “A review of the November 2006 hearing transcript finds no mention of tapes being destroyed.” [US Congress, 12/7/2007] The House Intelligence Committee was apparently informed in March 2007. [CBS News, 12/7/2007] However, the committee will say to Hayden that, “The notification came in the form of an offhand comment you made in response to a question,” and, “We do not consider this to be sufficient notification.” [US Congress, 12/7/2007] There is also a dispute over what happened when the committees were first informed of the videos’ existence. Hayden says, “The leaders of our oversight committees in Congress were informed of the videos years ago and of the Agency’s intention to dispose of the material.” [Central Intelligence Agency, 12/6/2007] Some political leaders were informed of the tapes in 2003, but urged that they not be destroyed (see November 2005).
President George Bush says he was unaware that the CIA had videotaped detainee interrogations. The CIA had videotaped some interrogations in 2002 (see Spring-Late 2002), but the tapes were destroyed in late 2005 (see November 2005), and this was disclosed five days previously (see December 6, 2007). Bush says, “My first recollection of whether the tapes existed or whether they were destroyed was when [CIA Director] Michael Hayden briefed me.” [ABC News, 12/11/2007] Bush took an interest in information coming from one of the detainees who was videotaped, Abu Zubaida (see Late March 2002), and normally a president would be informed about activities like the detainee interrogations. However, there appears to have been a long-standing deliberate policy of keeping Bush out of the loop regarding aggressive interrogation methods to protect him from any adverse consequences that might arise (see April 2002 and After).
Following appearances before the Senate and then House Intelligence Committees, CIA Director Michael Hayden takes a different line than the previous week over the CIA’s destruction of videotapes showing detainee interrogations. When the scandal first broke, he had said: “The leaders of our oversight committees in Congress were informed of the videos years ago and of the Agency’s intention to dispose of the material. Our oversight committees also have been told that the videos were, in fact, destroyed.” [Central Intelligence Agency, 12/6/2007] However, the committees protested (see December 7, 2007) and, after his closed-door meeting with the House committee on December 12, he says, “particularly at the time of the destruction we could have done an awful lot better at keeping the committee alerted and informed.” [Fox News, 12/13/2007] His private explanation to the Senate committee leaves many questions unanswered, but chairman Jay Rockefeller calls it “a useful and not yet complete hearing.” [Associated Press, 12/11/2007] House committee chairman Silvestre Reyes, who expresses the committee’s “frustration” at not being kept informed about the tapes, calls the meeting “the first step in what we feel is going to be a long-term investigation,” and says some parts of Hayden’s briefing are “stunning.” [Fox News, 12/13/2007] Hayden points out to both committees that he arrived at the CIA after the tapes had been destroyed, so “Other people in the agency know about this far better than I.” [Associated Press, 12/11/2007]

Ashfaq Parvez Kayani. Pakistan agrees to allow the US to increase its use of Predator drones to strike at al-Qaeda in Pakistan’s tribal region. [New York Times, 2/22/2008] At least three Predator attacks follow in the next months (see January 29, 2008, February 28, 2008, March 16, 2008) after a year of few or no attacks. Previously, Musharraf had issues with such strikes, but now the US has his unofficial tacit approval. Newsweek reports that the US now has “virtually unrestricted authority to hit targets in the border areas.” The US has pushed for more strikes partly because al-Qaeda has been launching more attacks from the tribal regions. But also, US officials are concerned that Musharraf is losing power and the new leaders will be more hostile to US operations in Pakistan. [Newsweek, 3/22/2008] Some of the Predator attacks are launched from secret CIA bases near the Pakistani towns of Islamabad and Jacobabad. The bases are first publicly mentioned in February 2008, and next to nothing is known about them. [New York Times, 2/22/2008; Washington Post, 3/27/2008]
CIA Director Michael Hayden and Director of National Intelligence Mike McConnell testify to a Senate committee that US officials had indeed waterboarded three terrorist suspects (see May 2002-2003, Mid-May 2002 and After, (November 2002), and After March 7, 2003). Hayden and McConnell, testifying before the Senate Intelligence Committee, say that while the CIA banned the use of waterboarding (see Between May and Late 2006), the agency might authorize it again if circumstances warranted. Hayden says that the CIA found it necessary to waterboard the three suspects—alleged 9/11 mastermind Khalid Shaikh Mohammed, militant training camp facilitator Abu Zubaida, and al-Qaeda manager Abd al-Rahim al-Nashiri—because the US believed they had information about an imminent attack, and because it needed information about al-Qaeda immediately. “Those two circumstances have changed,” says Hayden. McConnell calls waterboarding a “lawful technique” that could be used again if needed. Hayden says the CIA has held fewer than 100 detainees, and of those, less than a third were put through what he calls “enhanced techniques.” Hayden also admits that “private contractors” took part in subjecting detainees to those “enhanced techniques,” which many call torture. He says he is not sure if any contractors were involved in waterboarding anyone. Senator Richard Durbin (D-IL) calls for an immediate Justice Department investigation into whether waterboarding is a criminal act. [Wall Street Journal, 2/6/2008] Two days later, Attorney General Michael Mukasey announces his decision not to investigate the US’s use of waterboarding (see February 7, 2008).

In House testimony, FBI Director Robert Mueller and Lieutenant General Michael Maples of the Defense Intelligence Agency say that they stand by their agencies’ decisions not to waterboard detainees. Two days before, CIA Director Michael Hayden and Director of National Intelligence Mike McConnell testified that the CIA had used waterboarding and might do so again (see February 5, 2008). The Pentagon has banned its employees from using the tactic, and the FBI has stated, “its investigators do not use coercive tactics when interviewing terror suspects.” Rush Holt (D-NJ) asks Mueller and Maples why their agencies do not use coercive interrogation: “Do you never interrogate people who have critical information?” Mueller responds: “Our protocol is not to use coercive techniques. That is our protocol. We have lived by it. And it is sufficient and appropriate for our mission here in the United States.… We believe in the appropriateness of our techniques to our mission here in the United States.” Maples adds: “The Army Field Manual guides our efforts and the efforts of the armed forces.… We believe that the approaches that are in the Army Field Manual give us the tools that are necessary for the purpose under which we are conducting interrogations.” The field manual bans the use of coercion against detainees. [Think Progress, 2/7/2008] The same day, Attorney General Michael Mukasey announces his decision not to investigate the US’s use of waterboarding (see February 7, 2008).
Senator John McCain (R-AZ), the presumptive Republican nominee for president, urges President Bush to veto an upcoming bill prohibiting waterboarding and other extreme methods of interrogation after himself voting against the bill. The bill passes the Senate on a largely partisan 51-45 vote. It has already passed the House on a similar party-line vote, and Bush has already announced his intention to veto the bill. McCain has won a reputation as an advocate of prisoner rights and a staunch opponent of torture; his five-year stint as a POW in North Vietnam is well-known. But McCain voted against the legislation when it came up for a vote in the Senate, and he opposes the bill now. McCain says he is opposed to waterboarding, but does not want the CIA restricted to following the practices outlined in the US Army Field Manual, as the legislation would require. McCain says: “I knew I would be criticized for it. I think I can show my record is clear. I said there should be additional techniques allowed to other agencies of government as long as they were not” torture. “I was on the record as saying that they could use additional techniques as long as they were not cruel, inhumane and degrading treatment. So the vote was in keeping with my clear record of saying that they could have additional techniques, but those techniques could not violate” international rules against torture. McCain has said he believes waterboarding is already prohibited by the Detainee Treatment Act of 2005 (see December 30, 2005). And CIA director Michael Hayden has said that current law may well prohibit waterboarding; he claims to have stopped CIA agents from waterboarding detainees in 2006, and also claims that the technique was not used later than 2003. McCain’s Senate colleague, Charles Schumer (D-NY) says that if Bush vetoes the bill, then he in essence “will be voting in favor of waterboarding.” [New York Times, 2/13/2008; Associated Press, 2/21/2008] Bush will indeed veto the bill (see March 8, 2008).
CIA Director Michael Hayden and his top aides are told about one aspect of an agency program to capture and assassinate al-Qaeda leaders. The program was proposed in the wake of the 9/11 attacks and has been under development at the agency for years, although it has not yet become operational (see Shortly After September 17, 2001). Details of what Hayden is told are unclear, although he is told about plans that involve gathering sensitive information in a foreign country. Hayden orders that the operation be scaled back and that Congress be notified if the plans become more fully developed. However, Congress is not informed before Hayden’s successor cancels the program (see June 23, 2009). [New York Times, 7/14/2009]
President Bush vetoes legislation passed by Congress that would have banned the CIA from using waterboarding and other “extreme” interrogation techniques. The legislation is part of a larger bill authorizing US intelligence activities. The US Army prohibits the use of waterboarding and seven other interrogation techniques in the Army Field Manual; the legislation would have brought the CIA in line with US military practices. Waterboarding is banned by many countries and its use by the US and other regimes has been roundly condemned by US lawmakers and human rights organizations. The field manual also prohibits stripping prisoners naked; forcing them to perform or simulate sexual acts; beating, burning, or otherwise inflicting harm; subjecting prisoners to hypothermia; subjecting prisoners to mock executions; withholding food, water, or medical treatment; using dogs to frighten or attack prisoners; and hooding prisoners or strapping duct tape across their eyes.
Reasoning for Veto - “Because the danger remains, we need to ensure our intelligence officials have all the tools they need to stop the terrorists,” Bush explains. The vetoed legislation “would diminish these vital tools.” Bush goes on to say that the CIA’s interrogation program has helped stop terrorist attacks on a US Marine base in Djibouti and the US consulate in Pakistan, as well as stopped plans for terrorists to fly hijacked planes into a Los Angeles tower or perhaps London’s Heathrow Airport. He gives no specifics, but adds, “Were it not for this program, our intelligence community believes that al-Qaeda and its allies would have succeeded in launching another attack against the American homeland.” John D. Rockefeller (D-WV), the head of the Senate Intelligence Committee, disagrees, saying he knows of no instances where the CIA has used such methods of interrogation to obtain information that led to the prevention of a terrorist attack. “On the other hand, I do know that coercive interrogations can lead detainees to provide false information in order to make the interrogation stop,” he says. CIA Director Michael Hayden says that the CIA will continue to work within both national and international law, but its needs are different from those of the Army, and it will follow the procedures it thinks best. Bush complains that the legislation would eliminate not just waterboarding, but “all the alternative procedures we’ve developed to question the world’s most dangerous and violent terrorists.” [Reuters, 3/8/2008; Associated Press, 3/8/2008]
Criticism of Veto - Democrats, human rights leaders, and others denounce Bush’s veto. Senator Dianne Feinstein (D-CA) says, “This president had the chance to end the torture debate for good, yet he chose instead to leave the door open to use torture in the future.” Feinstein notes that Bush ignored the advice of 43 retired generals and admirals, and 18 national security experts, who all supported the bill. “Torture is a black mark against the United States,” she says. House Speaker Nancy Pelosi (D-CA) says she and fellow Democrats will try to override the veto and thus “reassert [the United States’s] moral authority.” Elisa Massimino of Human Rights First says, “The president’s refusal to sign this crucial legislation into law will undermine counterterrorism efforts globally and delay efforts to rebuild US credibility on human rights.” [Associated Press, 3/8/2008] New York Times journalist Steven Lee Myers writes that Bush vetoes the bill not just to assert his support for extreme interrogation techniques or to provide the government everything it needs to combat terrorism, but as part of his ongoing battle to expand the power of the presidency. Myers writes, “At the core of the administration’s position is a conviction that the executive branch must have unfettered freedom when it comes to prosecuting war.” [New York Times, 3/9/2008]

Alleged al-Qaeda leader Muhammad Rahim al-Afghani is transferred to the US-run prison in Guantanamo, Cuba, and officially declared a “high value” prisoner. Rahim was captured in Lahore, Pakistan, by local forces in July 2007 (see July 2007) and then was held in a secret CIA prison until his transfer to Guantanamo (see Late July 2007-March 14, 2008).
Why Is Rahim Considered Important? - Rahim is just the 16th person the US government has declared a “high value” prisoner. Fourteen prisoners were given that label when they were transferred from secret CIA prisons to Guantanamo in September 2006 (see September 6, 2006 and September 2-3, 2006). The 15th was Abd al-Hadi al-Iraqi, who was held by the CIA in autumn 2006 and sent to Guantanamo in April 2007 (see Autumn 2006-Late April 2007). [Los Angeles Times, 3/15/2008] Although there had been reports in Pakistan about Rahim shortly after his arrest, virtually nothing was known about him until his transfer to Guantanamo. [Asian News International, 8/2/2007] He may have experienced extreme sleep deprivation during CIA interrogations (see August and November 2007).
Hayden's Memo - There still are no published photographs of him. At the same time Rahim is sent to Guantanamo, CIA Director Michael Hayden issues a memo to CIA employees explaining Rahim’s alleged importance. Hayden calls Rahim a “tough, seasoned jihadist” with “high-level contacts,” and claims his arrest “was a blow to more than one terrorist network. He gave aid to al-Qaeda, the Taliban, and other anti-coalition militants.” According to Hayden, Rahim sought chemicals for an attack on US forces in Afghanistan and tried to recruit people who had access to US military facilities there. He helped prepare Tora Bora as a hideout in 2001, and then helped al-Qaeda operatives flee the area when US forces overran it in late 2001. But perhaps most importantly, Rahim had become one of Osama bin Laden’s most trusted facilitators and translators in the years prior to Rahim’s arrest. [Los Angeles Times, 3/15/2008; New York Times, 3/15/2008]
Navy Lieutenant Commander Brian Mizer, the lawyer for Guantanamo detainee Salim Hamdan, says that senior Pentagon officials are orchestrating war crimes prosecutions for the 2008 presidential campaign. In a court brief filed on this day, Mizer describes a September 29, 2006 meeting at the Pentagon where Deputy Defense Secretary Gordon England asked lawyers to consider 9/11-related prosecutions in light of the upcoming presidential campaign. “We need to think about charging some of the high-value detainees because there could be strategic political value to charging some of these detainees before the election,” England is quoted as saying (see September 29, 2006). Pentagon spokesman Bryan Whitman refuses to discuss specifics of the case, but says that the Pentagon “has always been extraordinarily careful to guard against any unlawful command influence” in upcoming military commissions trials. Mizer says that because of England’s instructions, and other examples of alleged political interference, his client cannot get a fair trial. Three weeks before England’s observation about the “strategic political value” of the trials, President Bush disclosed that he had ordered the CIA to transfer “high-value detainees” from years of secret custody to Guantanamo for trial.
Issues 'Scrambled' - Attorney Eugene Fidell, president of the National Institute of Military Justice, says the Hamdan motion exposes the problem of Pentagon appointees’ supervisory relationship to the war court. “It scrambles relationships that ought to be kept clear,” he says. England’s statement, says Fidell, is “enough that you’d want to hold an evidentiary hearing about it, with live witnesses. It does strike me as disturbing for there to be even a whiff of political considerations in what should be a quasi-judicial determination.” Susan Crawford is the White House-appointed supervisor for the court proceedings; England is a two-term White House appointee who has supervised the prison camps’ administrative processes. Crawford, England, and other White House officials have crossed the legal barriers that separate various functions of a military court, Mizer argues. Mizer plans to call the former chief prosecutor for the Guantanamo trials, Morris Davis (see October 4, 2007), who first brought the England remark to light. Davis resigned his position after contending that political influence was interfering with the proper legal procedures surrounding the prosecution of accused war criminals.
Motion for Dismissal - Mizer’s motion asks the judge, Navy Captain Keith Allred, to dismiss the case against Hamdan as an alleged 9/11 co-conspirator on the grounds that Bush administration officials have exerted “unlawful command influence.” Hamdan is a former driver for Osama bin Laden whose lawyers successfully challenged an earlier war court format (see June 30, 2006). Hamdan’s case is on track to be the first full-scale US war crimes tribunal since World War II. [Miami Herald, 3/28/2008]

Yousaf Raza Gillani. [Source: Public Domain]Pakistan’s prime minister, Yousaf Raza Gillani, visits the US and meets with President George Bush in Washington, D.C. Bush privately confronts Gillani with evidence that the ISI, Pakistan’s intelligence agency, has been helping the Taliban and al-Qaeda. US intelligence has long suspected that Pakistan has been playing a “double game,” accepting over a billion dollars of US aid per year meant to help finance Pakistan’s fight with Islamic militants, but at the same time training and funding those militants, who often go on to fight US soldiers in Afghanistan. The London Times reports that Gillani “was left in no doubt that the Bush administration had lost patience with the ISI’s alleged double game.” Bush allegedly warned that if one more attack in Afghanistan or elsewhere were traced back to Pakistan, the US would take “serious action.” The key evidence is that US intelligence claims to have intercepted communications showing that the ISI helped plan a militant attack on the Indian embassy in Kabul, Afghanistan, earlier in the month (see July 7, 2008). US officials will leak this story of ISI involvement to the New York Times several days after Bush’s meeting with Gillani (see August 1, 2008). Gillani also meets with CIA Director Michael Hayden, who confronts him with a dossier on ISI support for the Taliban. Pakistanis officials will claim they were shocked at the “grilling” they received. One Pakistani official who came to the US with Gillani will say, “They were very hot on the ISI. Very hot. When we asked them for more information, Bush laughed and said, ‘When we share information with your guys, the bad guys always run away’.” When the story of Bush’s confrontation with Gillani is leaked to the press, Pakistani officials categorically deny any link between the ISI and militants in Afghanistan. But senior British intelligence and government officials have also told the Pakistanis in recent days that they are convinced the ISI was involved in the embassy bombing. This is believed to be the first time the US has openly confronted Pakistan since a warning given several days after 9/11 (see September 13-15, 2001). The US is said to be particularly concerned with the ISI’s links to Jalaluddin Haqqani, who runs a militant network that the US believes was involved in the bombing. And the US is worries about links between the ISI and Lashkar-e-Toiba, a Pakistan-based militant group that is said to have been behind a recent attack against US forces in Afghanistan that killed nine. [London Times, 8/3/2008]
In a speech, CIA Director Michael Hayden says that Osama bin Laden is probably hiding in the tribal region of northwest Pakistan. He adds that bin Laden “is putting a lot of energy into his own survival, a lot of energy into his own security,” and is isolated from al-Qaeda’s daily operations. [BBC, 11/14/2008]
President-elect Barack Obama orders two days of secret briefings with the CIA on interrogation policies and procedures. He sends his chief counsel, Gregory Craig; his nominated National Security Adviser, James Jones; foreign policy adviser Denis McDonough; former senators David Boren (D-OK) and Chuck Hagel (R-NE); and former CIA general counsel Jeffrey H. Smith to Langley. They meet with CIA Director Michael Hayden, his deputy Stephen Kappes, and about 20 senior CIA officials, who brief Obama’s team on the agency’s counterterrorism and rendition programs. In the briefings, Hayden and his colleagues argue for the preservation of the agency’s secret prison and torture programs. Hayden acknowledges that the agency stopped using the secret prisons in 2006, and says that agency operatives stopped using waterboarding as an interrogation method in 2003. He wants the CIA to retain its option to use other “harsh methods” as needed. During the briefings, CIA officials acknowledge that some foreign intelligence agencies have begun withholding information about suspected terrorists from the agency for fear that they might become implicated in the eventual torture of those suspects. As Boren and Smith will later recall, the group is not convinced that whatever useful intelligence those methods may have garnered warrants keeping them as an option. “They said that they had produced valuable intelligence,” Smith will recall. “We took them at their word.” However, the group decides that “whatever utility it had at the outset… the secret prisons and enhanced techniques were no longer playing a useful role—the costs outweighed the gains.” Those costs include the palpable damage to America’s identity and values, and the lost credibility and prestige among many of its closest allies. Boren will later call attending the briefings “one of the most deeply disturbing experiences I have had.… I wanted to take a bath when I heard it. I was ashamed of it.” He believes that “fear was used to justify the use of techniques that violate our values and weaken our intelligence,” and that the agency did not prove those methods “are particularly effective at getting the truth.” [Washington Post, 4/24/2009]
Susan Crawford. [Source: Susan Crawford / Washington Post]The senior Bush administration official in charge of bringing Guantanamo Bay detainees to trial rules that the US military tortured a detainee, and therefore the US cannot try him. Susan Crawford, the convening authority of military commissions, says that the US tortured Mohamed al-Khatani, a Saudi national accused of planning to participate in the September 11 attacks (see August 4, 2001). Crawford says al-Khatani was interrogated with techniques that included sustained isolation, sleep deprivation, nudity and prolonged exposure to cold, and which cumulatively left him in a “life-threatening condition.” Crawford says: “We tortured [al-]Khatani. His treatment met the legal definition of torture. And that’s why I did not refer the case” for prosecution. Crawford is a retired judge who served as the Army’s general counsel during the Reagan administration and the Pentagon’s inspector general during the first Bush administration. She is the first senior official of the current Bush administration to publicly state that a detainee was tortured while in US custody.
Cumulative Effect Equals Torture - None of the individual techniques used against al-Khatani were torturous in and of themselves, Crawford says, but the cumulative effect—particularly their duration and the deleterious effect on al-Khatani’s health—combined to constitute torture. “The techniques they used were all authorized, but the manner in which they applied them was overly aggressive and too persistent,” she says. “You think of torture, you think of some horrendous physical act done to an individual. This was not any one particular act; this was just a combination of things that had a medical impact on him, that hurt his health. It was abusive and uncalled for. And coercive. Clearly coercive. It was that medical impact that pushed me over the edge” to call it torture. Al-Khatani has been in US custody since December 2001 (see December 2001), and was interrogated from November 2002 through January 2003 (reports of the exact dates vary—see August 8, 2002-January 15, 2003 and October 11, 2002). He was held in isolation until April 2003. “For 160 days his only contact was with the interrogators,” Crawford says. “Forty-eight of 54 consecutive days of 18-to-20-hour interrogations. Standing naked in front of a female agent. Subject to strip searches. And insults to his mother and sister.” He was threatened with a military dog named Zeus. He “was forced to wear a woman’s bra and had a thong placed on his head during the course of his interrogation,” Crawford says, and “was told that his mother and sister were whores.” With a leash tied to his chains, he was led around the room “and forced to perform a series of dog tricks,” according to reports from his interrogations. He was twice hospitalized with bradycardia, a potentially lethal condition where the heartbeat drops to abnormally low levels.
Ruling Halts Future Prosecution against al-Khatani - Crawford dismissed war crimes charges against al-Khatani in May 2008 (see May 13, 2008). In November, military prosecutors said they would refile charges against al-Khatani, based on subsequent interrogations that did not employ harsh techniques (see November 18, 2008). But Crawford says that she would not let any such prosecutions go forward. However, Crawford is not unaware of the potential danger posed by letting him go free. “There’s no doubt in my mind he would’ve been on one of those planes had he gained access to the country in August 2001,” Crawford says. “He’s a muscle hijacker.… He’s a very dangerous man. What do you do with him now if you don’t charge him and try him? I would be hesitant to say, ‘Let him go.’” Al-Khatani’s civilian lawyer, Gitanjali Gutierrez, says, “There is no doubt he was tortured.” Gutierrez says: “He has loss of concentration and memory loss, and he suffers from paranoia.… He wants just to get back to Saudi Arabia, get married and have a family.” Al-Khatani “adamantly denies he planned to join the 9/11 attack,” she adds. “He has no connections to extremists.” Gutierrez says she thinks Saudi Arabia has an effective rehabilitation program and Khatani ought to be returned there. [Washington Post, 1/14/2009; New York Times, 1/14/2009] His lawyers at the Center for Constitutional Rights describe him as a broken, suicidal man who can never be prosecuted because of his treatment at the hands of his captors. [New York Times, 1/14/2009]
Sympathetic but Unbending - Crawford, a lifelong Republican, says she sympathizes with the situation faced by the Bush administration and the CIA after the 9/11 attacks. “I sympathize with the intelligence gatherers in those days after 9/11, not knowing what was coming next and trying to gain information to keep us safe,” she acknowledges. “But there still has to be a line that we should not cross. And unfortunately what this has done, I think, has tainted everything going forward.” Noting that the 2006 Hamdan v. Rumsfeld case (see June 30, 2006) disallowed torture but allowed for “coercive interrogation techniques,” Crawford says even those techniques should not be allowed: “You don’t allow it in a regular court.” Crawford says she is not yet sure if any of the other five detainees accused of participating in the 9/11 plot, including their leader, Khalid Shaikh Mohammed, were tortured, but she believes they may have been. “I assume torture,” she says, and notes that CIA Director Michael Hayden has publicly confirmed that Mohammed was one of three detainees subjected to waterboarding, a technique classified by law as torture. Crawford has not blocked prosecution of the other five detainees. Ultimately, she says, the responsibility for the farrago of illegal detentions and torture rests with President Bush. He was right to create a system to try suspected terrorists, she says, but the implementation was fatally flawed. “I think he hurt his own effort.… I think someone should acknowledge that mistakes were made and that they hurt the effort and take responsibility for it.… We learn as children it’s easier to ask for forgiveness than it is for permission. I think the buck stops in the Oval Office.” [Washington Post, 1/14/2009]
Rules Change - Pentagon spokesman Geoff Morrell says that the Hamdan case changed the rules, and thus retroactively classified al-Khatani’s treatment as torture. “The [Defense] Department has always taken allegations of abuse seriously,” he says. “We have conducted more than a dozen investigations and reviews of our detention operations, including specifically the interrogation of Mohamed al-Khatani, the alleged 20th hijacker. They concluded the interrogation methods used at [Guantanamo], including the special techniques used on Khatani in 2002, were lawful. However, subsequent to those reviews, the Department adopted new and more restrictive policies and procedures for interrogation and detention operations. Some of the aggressive questioning techniques used on al-Khatani, although permissible at the time, are no longer allowed in the updated Army field manual.” [Washington Post, 1/14/2009]
Prosecutors Unprepared - When Crawford came to Guantanamo as convening authority in 2007, she says “the prosecution was unprepared” to bring cases to trial. Even after four years of working possible cases, “they were lacking in experience and judgment and leadership.” She continues: “A prosecutor has an ethical obligation to review all the evidence before making a charging decision. And they didn’t have access to all the evidence, including medical records, interrogation logs, and they were making charging decisions without looking at everything.” It took over a year, and the intervention of Deputy Defense Secretary Gordon England, for prosecutors to turn over possibly exculpatory evidence to defense lawyers, even though the law requires that such evidence be turned over immediately. The entire system at Guantanamo is a blot on the reputation of the US and its military judicial system, she says: “There’s an assumption out there that everybody was tortured. And everybody wasn’t tortured. But unfortunately perception is reality.” The system she oversees cannot function now, she believes. “Certainly in the public’s mind, or politically speaking, and certainly in the international community” it may be forever tainted. “It may be too late.” [Washington Post, 1/14/2009]

Michael Hayden, in the last days of his position as CIA director, defends the agency’s use of secret prisons and extreme interrogation methods on suspected terrorists. Hayden claims the techniques and practices helped prevent new terrorist attacks, though he refuses to provide evidence of this claim, and says that they were done “out of duty, not out of enthusiasm.” Hayden says the CIA detainee program should not be subject to a public investigation, because the program was made legal by secret Justice Department memos (see January 28, 2009) and some members of Congress were informed of the program’s existence. In addition, a public investigation could possibly damage the careers of CIA officers and the agency’s espionage operations. “We are asked to do things routinely that no one else is asked to do, that no one else is allowed to do,” Hayden says. “You can’t do this to these people.” Asked if he was concerned that Attorney General-designee Eric Holder unequivocally termed waterboarding as torture, Hayden responds, “It’s an uninteresting question to the Central Intelligence Agency.” He continues: “We don’t do that. We haven’t done it since March 2003, and we don’t intend to do it. What the agency has done in the past, what it is doing now, what it will do in the future is based on the best legal counsel it has at the time.” Hayden says he was “heartened” by President Obama’s recent remarks that the nation must “move beyond” the Bush years. In a letter to Judge Alvin Hellerstein regarding the American Civil Liberties Union (ACLU)‘s lawsuit against the US Defense Department, the Justice Department informs Hellerstein that the CIA destroyed 92 videotapes of prisoner interrogations. The CIA’s previous admissions of the number of destroyed videotapes were far smaller (see November 2005). [Re: ACLU et al v. Department of Defense et al, 3/2/2009 ] The CIA confirms that the tapes showed what it calls “enhanced interrogation techniques” used on a number of detainees. The Justice Department adds that it will provide a list of summaries, transcripts, and memoranda related to the destroyed tapes, though the American Civil Liberties Union notes that a previous list was almost entirely redacted. [TPM Muckraker, 3/6/2009; American Civil Liberties Union, 3/6/2009] The disclosure comes as part of a criminal inquiry into the tapes’ destruction. As the investigation comes to a close, observers expect that no charges will be filed against any CIA employees. The agency’s Directorate of Operations chief, Jose Rodriguez, ordered the recordings destroyed in November 2005 (see November 2005); former CIA Director Michael Hayden argued that the tapes posed “a serious security risk” because they contained the identities of CIA participants in al-Qaeda interrogations. Rodriguez has not yet been questioned. It is believed that the tapes show, among other interrogation sessions, the waterboarding of two detainees, Abu Zubaida (see Mid-May 2002 and After) and Abd al-Rahim al-Nashiri (see (November 2002)). Civil libertarians and human rights advocates are outraged at the destruction of the tapes. “The sheer number of tapes at issue demonstrates that this destruction was not an accident,” says Amrit Singh, a staff lawyer with the American Civil Liberties Union (ACLU). “It’s about time the CIA was held accountable for its flagrant violation of the law,” she adds. CIA spokesman George Little says the destruction of the tapes was not an attempt to break the law or evade accountability. “If anyone thinks it’s agency policy to impede the enforcement of American law, they simply don’t know the facts,” Little says. Senator Dianne Feinstein (D-CA), who chairs the Senate Intelligence Committee, confirms that her panel intends to conduct a broader investigation of the CIA’s interrogation program. The Justice Department informs CIA Director Leon Panetta that, after due deliberation, it will recommend to the White House that it release four Bush-era “torture memos” almost uncensored (see April 16, 2009), in compliance with a Freedom of Information Act lawsuit filed by the American Civil Liberties Union (ACLU). Panetta, who is about to leave for an overseas trip, tells Attorney General Eric Holder and White House officials that the administration needs to consider the possibility that the memos’ release might expose CIA officers to lawsuits on allegations of torture and abuse. He also demands more censorship of the memos. The Justice Department informs other senior CIA officials, and as a courtesy, former agency directors Michael Hayden, Porter Goss, George Tenet, and John Deutch. Senior CIA officials object, arguing that the memos’ release could damage the agency’s ability to interrogate prisoners in the future and would further besmirch CIA officers who had acted on the Bush administration’s legal guidance. They also warn that the release might harm foreign intelligence services’ trust in the CIA’s ability to protect national security secrets. The four former directors also raise objections, arguing that the release might compromise ongoing intelligence operations. The torture authorized by the Bush White House had been approved under Tenet’s directorship. On March 19, the Justice Department requests a two-week delay in releasing the memos; department officials tell the court handling the lawsuit that the administration is considering releasing the memos without waiting for a court verdict. Two weeks later, Justice Department officials tell the court that the memos would come out on or before April 16. President Obama becomes more and more involved in the matter, leading a National Security Council (NSC) session on the issue and holding high-level sessions with Holder and other Cabinet members. Obama also discusses the issue with lower-level officials, and with an unidentified NSC official from the Bush administration. Obama’s biggest worry is the possibility of endangering ongoing intelligence operations. The Justice Department argues that the ACLU lawsuit would in the end force the administration to release the documents anyway. Obama eventually agrees, and the White House decides it will be better to release the memos voluntarily and avoid the perception of only releasing them after being forced to do so by a court ruling. Obama also decides that very few redactions should be made in the documents. The only redactions in the memos are the names of US employees, foreign services, and items related to techniques still in use. To mollify CIA personnel concerns, Obama will send a personal letter to CIA employees reassuring them that he supports them, understands the clandestine nature of their operations, and has no intention of prosecuting CIA employees who followed the legal guidelines set forth in the memos. Former CIA Director Michael Hayden refuses to confirm information from a recently released CIA memo that shows alleged 9/11 mastermind Khalid Shaikh Mohammed had been waterboarded 183 times in a single month (see April 16, 2009). Even though the memo has been released to the public, Hayden says he believes that information is still classified. Hayden says he opposed the release of the memo and three others recently released by the White House. Even though President Obama has said that the US will never use waterboarding and other “harsh interrogation techniques” again, Hayden says: “At the tactical level, what we have described for our enemies in the midst of a war are the outer limits that any American would ever go to in terms of interrogating an al-Qaeda terrorist. That’s very valuable information. Now, it doesn’t mean we would always go to the outer limits, but it describes the box within which Americans will not go beyond. To me, that’s very useful for our enemies, even if as a policy matter, this president at this time had decided not to use one, any, or all of those techniques. It reveals the outer limits. That’s very important.” Hayden also disputes reports that suspected terrorist Abu Zubaida revealed nothing new after being tortured; he says that after Zubaida was subjected to waterboarding and other unspecified “techniques,” he revealed information leading to the capture of suspected terrorist Ramzi bin al-Shibh. [New York Times, 4/19/2009; Think Progress, 4/19/2009] Days later, former FBI interrogator Ali Soufan will reveal information that disputes Hayden’s claims (see Late March through Early June, 2002 and April 22, 2009).
Seven former directors of the CIA urge President Obama to end the investigation of claims that the CIA tortured detainees to obtain intelligence (see August 24, 2009). The investigation was triggered by the release of an internal CIA report from 2004 (see August 24, 2009). The directors say that all the cases in the 2004 report have already been adequately investigated, and to reopen those investigations would make it difficult for intelligence agents to believe they can safely follow legal guidance. In a letter signed by the seven former directors, they write: “Attorney General Holder’s decision to re-open the criminal investigation creates an atmosphere of continuous jeopardy for those whose cases the Department of Justice had previously declined to prosecute. Those men and women who undertake difficult intelligence assignments in the aftermath of an attack such as September 11 must believe there is permanence in the legal rules that govern their actions.… [T]his approach will seriously damage the willingness of many other intelligence officers to take risks to protect the country.” The letter is signed by former CIA directors Michael Hayden, Porter Goss, George Tenet, John Deutch, James Woolsey, William Webster, and James Schlesinger. Current CIA Director Leon Panetta opposed the investigation, but says that he will cooperate with it (see Before August 24, 2009). [Fox News, 9/18/2009]
ACLU: Letter 'Self-Serving' and Wrong - The American Civil Liberties Union’s Jameel Jaffer calls the letter “self-serving,” writing: “Attorney General Holder initiated a criminal investigation because the available evidence shows that prisoners were abused and tortured in CIA custody. The suggestion that President Obama should order Attorney General Holder to abort the investigation betrays a misunderstanding of the role of the attorney general as well as the relationship between the attorney general and the president. Where there is evidence of criminal conduct, the attorney general has not just the authority but the duty to investigate. The attorney general is the people’s lawyer, not the president’s lawyer, and it would be profoundly inappropriate for President Obama to interfere with his work. The attorney general’s investigation should be allowed to proceed without interference, and it certainly should not be derailed by the self-serving protests of former CIA officials who oversaw the very crimes that are being investigated. If there is a problem with the unfolding criminal investigation, it is that its focus is too narrow. There is abundant evidence that torture was authorized at the highest levels of the Bush administration, and the Justice Department’s investigation should be broad enough to encompass Bush administration lawyers and senior officials—including the CIA officials—who authorized torture.” [TPM Muckraker, 9/18/2009]
Justice Department Responds - The Justice Department counters the letter with its own statement: “The attorney general works closely with the men and the women of intelligence community to keep the American people safe and he does not believe their commitment to conduct that important work will waver in any way. Given the recommendation from the Office of Professional Responsibility as well as other available information, he believed the appropriate course of action was to ask John Durham to conduct a preliminary review. That review will be narrowly focused and will be conducted by a career prosecutor who has shown an ability to handle cases involving classified information. Durham has not been appointed as a special prosecutor; he will be supervised by senior managers at the [Justice] Department. The attorney general’s decision to order a preliminary review into this matter was made in line with his duty to examine the facts and to follow the law. As he has made clear, the Department of Justice will not prosecute anyone who acted in good faith and within the scope of the legal guidance given by the Office of Legal Counsel regarding the interrogation of detainees.” [Washington Independent, 9/18/2009]
