Because neoconservatives have so little influence in the Clinton administration, two founding fathers of the movement, Irving Kristol and Norman Podhoretz, begin advocating for the forging of an alliance with the Christian Right, no matter how undemocratic some fundamentalists can be. In his book Neoconservatism: The Autobiography of an Idea (see 1965), Kristol wrote: “[C]onservatives and the Republican Party must embrace the religious if they are to survive.… Religious people always create problems since their ardor tends to outrun the limits of politics in a constitutional democracy. But, if the Republican Party is to survive, it must work on accommodating those people.” Following Kristol’s lead, Podhoretz writes that Jews should ignore the direct anti-Semitism of televangelist Pat Robertson because “Robertson’s support for Israel trumps the anti-Semitic pedigree of his ideas.” Neoconservative academic and intelligence figure Michael Ledeen makes numerous appearances on Robertson’s televised 700 Club to promote the strategy of revamping the Middle East to suit Israel and the US, reaching millions of fundamentalist viewers. [Unger, 2007, pp. 150]
Disbarred lawyer and convicted Watergate figure Charles Colson (see June 1974), now the head of the Christian Prison Fellowship ministry, writes that “the Constitution does not give the Supreme Court final say on constitutional questions.” Colson, a traditional social conservative, makes this startling claim in an op-ed about the recent Boerne v. Flores decision of the Court, in which the Court struck down the Religious Freedom Restoration Act (RFRA) as an unconstitutional encroachment on the fundamental concept of the separation of church and state. Colson writes that the decision has “precipitat[ed] what may be the greatest constitutional crisis of our age.” Colson, a supporter of the RFRA, says the striking down of the act makes “religious liberties… once again vulnerable.” The overarching question Colson raises is whether the Supreme Court is the final judicial arbiter of the Constitution. Colson gives a blunt answer: “Contrary to what most Americans think, the Constitution does not give the Supreme Court final say on constitutional questions. And the Founders resisted the idea.” Colson cites the landmark 1803 case of Marbury v. Madison, in which the Court, he says, took up the power of judicial review, then gives three examples of presidents defying Court orders. However, fellow convicted Watergate figure John Dean, a former White House counsel, refutes Colson’s arguments. In 2006, Dean will write that “Colson, like [televangelist Pat] Robertson and others on the religious right, is seeking, in effect, to nullify Supreme Court decisions of which he does not approve.” Dean will note that although Colson has long since lost his license to practice law, he is considered a scholar of some importance by his conservative contemporaries, and therefore has some influence.
'Marbury' and Judicial Review - Dean notes that Colson’s interpretation of the bedrock Marbury case is wrong. Judicial review by federal courts of Congressional legislation was a long-established principle by the time the Court issued its ruling. Even before the Constitutional Conventions, state courts had routinely overturned state legislative acts. The assumption of most during the debates over the contents of the Constitution was that federal courts, and most specifically the Supreme Court, would have similar power over federal legislation.
Thomas Jefferson and the Alien Imposition Act - Colson writes that “Thomas Jefferson refused to execute the Alien Imposition Act.” Colson is wrong: there was never such an act. Dean writes, “If Colson is referring to the infamous Alien and Sedition Act of 1798, it had nothing to do with a court order, and the example is therefore very misleading.” Jefferson’s predecessor, John Adams, enforced the law, which Jefferson considered unconstitutional. Jefferson pardoned those convicted of sedition under the statute when he gained the presidency. He never “refused to execute” it because it expired the day before he was inaugurated, March 4, 1801.
Andrew Jackson and the Bank of the United States - Colson writes that Andrew Jackson “spurned a Court order in a banking case.” Again, as Dean notes, the citation is misleading. Dean believes Colson is referring to Jackson’s 1832 veto of a bill to recharter the Bank of the United States. The Court had not issued an opinion on the rechartering of a federal bank, so Jackson did not defy a Court order.
Abraham Lincoln and the 'Dred Scott' Decision - Colson concludes his historical argument by saying that Abraham Lincoln “rejected the Dred Scott decision. Lincoln even asked Congress to overrule the Court—which it did, passing a law that reversed Dred Scott (1862).” Dean calls Colson’s argument “a stunning summation, not to mention distortion, of history.” The infamous 1857 Dred Scott v. Sanford decision found that slaves were neither citizens nor persons under the Constitution, that Congress could not prohibit slavery in the territories, and that the Declaration of Independence’s statement that “all men are created equal” applied only to white men. Lincoln argued passionately against the decision during his 1858 debates with his Senate opponent, Stephen Douglas, and swore that he would seek to reverse the decision. But, as Dean will note, “Seeking reversal is not defiance of the law.” Lincoln did defy the Court in 1861 by suspending the writ of habeas corpus, and explained his unprecedented action to Congress by arguing that he did so to save the Union from dissolution. Dred Scott was overturned, not by Congressional legislation, but by the Thirteenth and Fourteenth Amendments to the Bill of Rights.
The Danger Inherent in Colson's Arguments - Dean will note: “Colson’s baseless arguments are unfortunately typical of those that authoritarian conservatives insist on making, using facts that are irrelevant or misleading, if not demonstrably wrong. The self-righteousness of authoritarians [such as] Colson and Pat Robertson… has become so pronounced that at times it seems as if they believe themselves actually to be speaking ex cathedra [a sardonic reference to the infallibility of the Pope]. Their contention that the president of the United States is not bound by rulings of the Supreme Court, or, for that matter, by the laws of Congress, when these rulings or laws relate to the functions of the presidency, has gained increasing currency with authoritarian conservatives, both leaders and followers.” Such acceptance “is truly frightening in its implications.” [Christianity Today, 10/6/1997; Dean, 2006, pp. 111-115; Catholic Encyclopedia, 2008]

On his 700 Club broadcast, Robertson says: “I know it sounds somewhat Machiavellian and evil, to think that you could send a squad in to take out somebody like Osama bin Laden, or to take out the head of North Korea.… But isn’t it better to do something like that, to take out [Serbian leader Slobodan] Milosevic, to take out [Iraq’s] Saddam Hussein, rather than to spend billions of dollars on a war that harms innocent civilians and destroys the infrastructure of a country?” [Christianity Today, 8/2005; The Age, 8/25/2005]
Televangelist Pat Robertson, the head of the Christian Coalition and a former Republican presidential candidate, says that while he is staunchly opposed to abortion, he believes that China’s one-child policy, which he seems to think includes forcible abortions for families with more than one child, is acceptable. Robertson, who has admitted to having extensive personal business interests in China, says that nation suffers from “tremendous unemployment” and is plagued with “antiquated factories” owned by the government “that will have to be shut down, spawning more loss of jobs.… So, I think that right now they are doing what they have to do. I don’t agree with forced abortion, but I don’t think the United States needs to interfere with what they’re doing internally in this regard.” Robertson adds that the Chinese are “courting a demographic catastrophe” by aborting more girls than boys, and speculates that in 10 or 20 years Chinese men will have to import wives from Indonesia, which “will, in a sense, dilute the—what they consider the racial purity of the Han Chinese.” [Feminist Women's Health Center News, 2010]
Pat Robertson and Jerry Falwell on the 700 Club. [Source: Tampa Bay Coalition]During a guest appearance on Pat Robertson’s 700 Club, televangelist Jerry Falwell tells listeners who he believes is responsible for the 9/11 attacks: homosexuals, abortionists, and the American Civil Liberties Union.
Falwell: “I fear, as Donald Rumsfeld, the secretary of defense said yesterday, that this is only the beginning. And with biological warfare available to these monsters; the Husseins, the bin Ladens, the Arafats, what we saw on Tuesday, as terrible as it is, could be miniscule if, in fact, if in fact God continues to lift the curtain and allow the enemies of America to give us probably what we deserve.”
Robertson: “Jerry, that’s my feeling. I think we’ve just seen the antechamber to terror. We haven’t even begun to see what they can do to the major population.”
Falwell: “The ACLU’s got to take a lot of blame for this.”
Robertson: “Well, yes.”
Falwell: “And, I know that I’ll hear from them for this. But, throwing God out successfully with the help of the federal court system, throwing God out of the public square, out of the schools. The abortionists have got to bear some burden for this because God will not be mocked. And when we destroy 40 million little innocent babies, we make God mad. I really believe that the pagans, and the abortionists, and the feminists, and the gays and the lesbians who are actively trying to make that an alternative lifestyle, the ACLU, People For the American Way, all of them who have tried to secularize America. I point the finger in their face and say ‘you helped this happen.’”
Robertson: “Well, I totally concur, and the problem is we have adopted that agenda at the highest levels of our government. And so we’re responsible as a free society for what the top people do. And, the top people, of course, is the court system.”
Falwell: “Amen. Pat, did you notice yesterday? The ACLU, and all the Christ-haters, the People For the American Way, NOW [the National Organization for Women], etc. were totally disregarded by the Democrats and the Republicans in both houses of Congress as they went out on the steps and called out on to God in prayer and sang ‘God Bless America’ and said ‘let the ACLU be hanged.’” [Washington Post, 9/14/2001; People for the American Way, 9/17/2001; Unger, 2007, pp. 217-218]
In a prayer during the broadcast, Robertson intones: “We have sinned against Almighty God, at the highest level of our government, we’ve stuck our finger in your eye. The Supreme Court has insulted you over and over again, Lord. They’ve taken your Bible away from the schools. They’ve forbidden little children to pray. They’ve taken the knowledge of God as best they can, and organizations have come into court to take the knowledge of God out of the public square of America.” [CNN, 9/14/2001; People for the American Way, 9/17/2001] The next day, after a firestorm of critical response (see September 13-14, 2001), Falwell will retreat somewhat from his remarks (see September 14, 2001), and again three days later (see September 17, 2001). But three years later, he will misrepresent his remarks and once again attack homosexuals (see November 28, 2004).
The response to televangelists Jerry Falwell and Pat Robertson’s blaming 9/11 on homosexuals, pro-choice believers, and civil liberties groups (see September 13, 2001) is quick and fierce. Even the White House refuses to join Falwell and Robertson in their comments, with a White House spokesman calling the statements “inappropriate” and saying, “The president does not share those views.” Ralph G. Neas, the head of People for the American Way, calls the remarks “absolutely inappropriate and irresponsible.” An American Civil Liberties Union spokeswoman says the organization “will not dignify the Falwell-Robertson remarks with a comment.” [Washington Post, 9/14/2001] Lorri L. Jean, the executive director of the National Gay and Lesbian Task Force, demands an apology from Falwell. “The terrible tragedy that has befallen our nation, and indeed the entire global community, is the sad byproduct of fanaticism,” she says. “It has its roots in the same fanaticism that enables people like Jerry Falwell to preach hate against those who do not think, live, or love in the exact same way he does. The tragedies that have occurred this week did not occur because someone made God mad, as Mr. Falwell asserts. They occurred because of hate, pure and simple. It is time to move beyond a place of hate and to a place of healing. We hope that Mr. Falwell will apologize to the US and world communities.” [CNN, 9/14/2001]
Televangelist Jerry Falwell writes an explanation of his recent comments blaming gays, civil libertarians, and pro-choice advocates for the 9/11 attacks (see September 13, 2001). Falwell writes that though people may have gotten the wrong “impression” from “news reports over the past several days,” he blames “no one other than the terrorists, and the people and nations who have enabled and harbored them, responsible for the September 11 attacks on this nation.” He says his comments “were taken out of their context and reported, and that my thoughts—reduced to sound bites—have detracted from the spirit of this time of mourning.” He says that since the afternoon of the attacks, he has led numerous groups in prayer, from his “Liberty University family of thousands” to his church congregation and, on September 14, at a special Day of Prayer held at the National Cathedral with President Bush in attendance. Falwell says that his statements were “called divisive by some whom I mentioned by name. I had no intention of being divisive. I was sharing my burden for revival in America on a Christian TV program, intending to speak to a Christian audience from a theological perspective about the need for national repentance. In retrospect, I should have mentioned the national sins without mentioning the organizations and persons by name.”
Apology, Then Attack - Falwell then launches into a condemnation of the practice of abortion, and accuses the US of “expell[ing] God from the public square and the public schools.” He accuses the nation of “normaliz[ing] an immoral lifestyle [homosexuality] God has condemned,” adding: “American families are falling apart. Because of our national moral and spiritual decline during the past 35 years, I expressed my personal belief that we have displeased the Lord and incurred his displeasure.” He writes that he was asking his “Christian audience” to follow Biblical teachings and “repent,” and for the “church to heed Proverbs 14:34, which says in paraphrase, ‘Living by God’s principles promotes a nation to greatness; violating those principles brings a nation to shame.’ I was blaming no one but the terrorists for the terror, but I was chastising us, the Church, for a generation of departure from God. I was doing what I have done for nearly 50 years in the pulpit—confronting the culture and calling for national revival.”
'Ill-Timed Comments' - Falwell then turns back towards explaining his remarks, saying his mistake was “doing this at the time I did it, on television, where a secular media and audience were also listening.” He adds: “And as I enumerated the sins of an unbelieving culture, because of very limited time on the 700 Club, I failed to point the finger at a sleeping, prayerless and carnal church. We believers must also acknowledge our sins, repent, and fast and pray for national revival.… [If] my statements seemed harsh and ill-timed, I truly regret this and apologize. But, I repeat, I blame no one but the hijackers and terrorists for the horrific happenings of September 11. But I do believe God’s protection of us as individuals and as a nation is dependent upon our obedience to His laws.” [National Liberty Journal, 9/17/2001] Falwell will make essentially the same arguments three years later; then, he will claim to have included his criticisms of the church in his original remarks, criticisms he today admits he failed to make (see November 28, 2004).
Televangelist Pat Robertson says the US should have merely assassinated Saddam Hussein instead of relying on a large and costly invasion to take out the Iraqi dictator. On CNN, Robertson answers a question about his previous warning that God thought the war could be a disaster. Robertson says: “Well, I don’t think God’s opposed to the war, necessarily, but it was a danger sign. I felt very uneasy about it from the very get-go. Whenever I heard about it, I knew it was going to be trouble. I warned the president.… I said, ‘You better prepare the American people for some serious casualties.’ And he said, ‘Oh, no, our troops are, you know, so well protected, we don’t have to worry about that.’ But it has been messy. And I think we’re going to come out of it, though. I think we’ll have a free Iraq. But it certainly has been a mess so far.… Our forces are going to war, and we support them. But if I had been doing it, I think I would have much preferred the assassination route. I think we could have gotten Saddam Hussein a lot easier than this.” [MSNBC, 6/22/2004] In 1999, Robertson advocated the assassination of the leaders of countries such as Serbia, Iraq, and North Korea, as well as Islamic militant leader Osama bin Laden (see August 9, 1999).
Televangelist Pat Robertson informs his viewers that God intends to remove three “liberal” Supreme Court Justices in time for President Bush to replace them with conservatives. According to Robertson, the Lord has told him, “I will remove judges from the Supreme Court quickly, and their successors will refuse to sanction the attacks on religious faith.” He asks his viewers to pray that three of the liberal justices retire. In 2003, he made similar remarks, and said: “I don’t care which three, I mean as long as the three conservatives stay on. Robertson makes his statement on The 700 Club, the flagship broadcast of his Christian Broadcast Network. The US should assassinate Chavez to prevent Venezuela from becoming “a launching pad for communist infiltration and Muslim extremism.” Robertson says: “We have the ability to take him out, and I think the time has come that we exercise that ability. We don’t need another $200 billion war to get rid of one, you know, strong-arm dictator [referring to Iraq’s Saddam Hussein]. It’s a whole lot easier to have some of the covert operatives do the job and then get it over with.… You know, I don’t know about this doctrine of assassination, but if he thinks we’re trying to assassinate him, I think that we really ought to go ahead and do it. [Source: New York Times]Christian broadcaster Pat Robertson says that a recent stroke suffered by Israeli Prime Minister Ariel Sharon is divine punishment for “dividing God’s land.” [Associated Press, 1/5/2006] Sharon is in a deep coma after suffering what doctors say is a severe stroke. Sharon, in critical condition, is assumed to be unable to return to public life. His deputy, Ehud Olmert, is named acting prime minister. [New York Times, 1/5/2006] On his television program, The 700 Club, Robertson says: “God considers this land to be his. You read the Bible and he says ‘This is my land,’ and for any prime minister of Israel who decides he is going to carve it up and give it away, God says, ‘No, this is mine.’” Sharon ordered Israel to withdraw from the Gaza Strip in 2005. Robertson adds that Sharon is “a very tender-hearted man and a good friend” and he is saddened to know that Sharon is so debilitated. However, he says the Bible “makes it very clear that God has enmity against those who ‘divide my land.’” Sharon “was dividing God’s land and I would say woe unto any prime minister of Israel who takes a similar course to appease the EU (European Union), the United Nations, or the United States of America.” Robertson implies that God also struck down former Prime Minister Yitzhak Rabin, who was assassinated after working to give land to the Palestinian people (see November 4, 1995). “It was a terrible thing that happened, but nevertheless he was dead,” Robertson says. The Anti-Defamation League, a Jewish organization, issues a statement urging Christian leaders to distance themselves from the remarks. “It is outrageous and shocking, but not surprising, that Pat Robertson once again has suggested that God will punish Israel’s leaders for any decision to give up land to the Palestinians,” says ADL director Abraham Foxman. “His remarks are un-Christian and a perversion of religion. Unlike Robertson, we don’t see God as cruel and vengeful.” Reverend Barry Lynn of Americans United for Separation of Church and State says a religious leader “should not be making callous political points while a man is struggling for his life. Pat Robertson has a political agenda for the entire world, and he seems to think God is ready to take out any world leader who stands in the way of that agenda.” [Associated Press, 1/5/2006] “Those comments are wholly inappropriate and offensive and really don’t have a place in this or any other debate,” says White House spokesman Trent Duffy. Senate Minority Leader Harry Reid (D-NV) calls Robertson’s statement “completely outrageous, insulting, and inappropriate.” Sharon “is fighting for his life,” Reid says. “He and his family deserve our thoughts and prayers, and I hope Mr. Robertson will offer them after he apologizes.” [MSNBC, 1/6/2006]
Israel cuts American Christian broadcaster Pat Robertson out of a plan to build an evangelical Christian heritage center along the Sea of Galilee, in apparent retribution for Robertson’s recent statement that Israeli Prime Minister Ariel Sharon was given a stroke by God as punishment for giving Israeli land to Palestinian settlers (see January 5, 2006). Deputy Tourism Minister Rami Levy says, “From our perspective, such a statement made for a person that is lying in a hospital bed is outrageous.” Robertson led a group of Christian evangelicals in planning the $50 million center, a joint venture with the state of Israel. The center is to be built along the Sea of Galilee, where Christians believe Jesus walked on water. The project will continue without Robertson’s participation, Levy says, adding, “Same joint venture, just the players are going to be changed.” The Reverend Ted Haggard, president of the National Association of Evangelicals, calls the decision “a blow to evangelical-Israeli relations.” For the project to go forward, Haggard says, evangelical leaders “must exercise sensitivity and grace towards the people and leadership of the nation of Israel.” [CNN, 1/12/2006]
A Wichita, Kansas, jury convicts Scott Roeder of first-degree murder in the shooting death of Dr. George Tiller, one of the few doctors in the country to perform late-term abortions (see May 31, 2009 and May 31, 2009). The jury only deliberates for 37 minutes before handing down its verdict. Roeder admitted shooting Tiller during the trial, said he felt no remorse whatsoever for his actions, and instead justified them by saying he saw no other way to prevent abortions. Roeder will receive a sentence of life in prison; prosecutors say they hope to add restrictions to his sentence that will prevent him from coming up for parole for 50 years. Dr. Tiller’s widow, Jeanne Tiller, says in a statement, “At this time, we hope that George can be remembered for his legacy of service to women (see January 20, 2010), the help he provided for those who needed it, and the love and happiness he provided us as a husband, father, and grandfather.” [New York Times, 1/29/2010; AlterNet, 1/29/2010]
Roeder Traced Belief to Conservative Televangelist - During the trial, Roeder said that he became a fervent Christian in 1992 after watching televangelist Pat Robertson’s 700 Club. He said he fell to his knees at the end of the show, during the customary appeal to viewers to “commit your life to Christ.” From then on, Roeder said, his Christian views went “hand in hand” with his opposition to abortion. Reporter Adele Stan writes, “The interesting thing in all this is not that Roeder converted to Christianity, but that he did so via a ministry whose definition of Christianity is the demonization of those who oppose the views of those who embrace one particular theological strain of Christianity.” [AlterNet, 1/29/2010]
Abortion Rights Organizations Say Roeder's Conviction Sends Powerful Message to Perpetrators of Violence - Abortion-rights organizations applaud Roeder’s conviction, saying it sends a clear and powerful message to those who would commit violence against abortion providers, and add that it also points up the need for more intensive law enforcement and investigations into those conspiring to commit such violence (see May 31, 2009). “They need to take this investigation to the next stage,” says Katherine Spillar of the Feminist Majority Foundation. “We don’t have rigorous enough enforcement.”
Anti-Abortion Organizations Split on Verdict - Some anti-abortion organizations call the trial unfair, and say that the guilty verdict will breed more violence. Troy Newman, president of the anti-abortion organization Operation Rescue (OR—see 1986), denounces Roeder as a “cold, calculated, and despicable” killer, and says Roeder does not represent the anti-abortion movement. However, Randall Terry, the former head of OR, calls the trial a “scam” and contends that Roeder had never been allowed to “really tell his side of the story.” Terry, who now leads a far-right anti-abortion organization called Insurrecta Nex, says Roeder should have been allowed to use descriptions and images of aborted fetuses to help jurors understand why he felt compelled to kill Tiller. Others take Terry’s position even further. “People had said if he were acquitted it would be open season on doctors,” says convicted clinic bomber Michael Bray (see September 1994). “But if you want to see what’s going to stimulate people to do something, you’re inviting more of the same by not giving him a fair trial.” Bray and other abortion opponents say Judge Warren Wilbert erred in not allowing the jury to consider a charge of voluntary manslaughter if it decided that, under Kansas law, “an unreasonable but honest belief that circumstances existed that justified deadly force.” The judge refused to allow that charge to be considered.
