Although neoconservative Paul Wolfowitz has lost his chance of becoming director of the CIA due to his sexual entanglements with foreign nationals (see Late December 2000), he has not been entirely dismissed from consideration for high positions, and has the support of Vice President Cheney. President Bush, who has insisted that his administration’s officials comply with the highest moral standards, never learns about Wolfowitz’s infidelities. (A letter that Wolfowitz’s wife wrote to Bush about her husband’s affairs was intercepted by Cheney’s chief of staff, Lewis Libby. Wolfowitz himself unleashed a group of lawyers on his wife and forced her to sign a non-disclosure agreement to keep quiet about his affairs.) Incoming Defense Secretary Donald Rumsfeld chooses Wolfowitz to be his deputy, blocking incoming Secretary of State Colin Powell’s choice for the position, Richard Armitage, from taking the office (see Late December 2000 and Early January 2001). The Washington Post calls Wolfowitz’s selection “another victory for… Cheney over… Powell.” Rumsfeld knows about Wolfowitz’s sexual liaisons, as do most White House officials, and chooses to remain silent. “Rumsfeld told Wolfowitz to keep it zipped,” a State Department source later says. “He didn’t want any problems. Days before President-elect Bush is inaugurated, Speaker of the House Dennis Hastert (R-IL) offers Vice President-Elect Cheney a second office in the US Congress. (To make room for Cheney in the exceedingly cramped work area, Hastert ejects Representative Bill Thomas (R-CA), chairman of the House Ways and Means Committee, from part of his suite of committee offices near the House chambers.) Hastert’s move is much more than mere symbolism or even political kowtowing. Now, when legislators negotiate with Cheney, they must come to his office on Capitol Hill instead of Cheney coming to the Hill. According to former House Appropriations Committee clerk Scott Lilly: “Offering office space to the vice president represented more than a breach in the symbolism concerning the powers and autonomy of the House of Representatives. Hastert’s plan was to convert the House into a compliant and subservient role player inside the White House political organization.” [Dubose and Bernstein, 2006, pp. 191]

There are discussions among future members of the Bush administration, including Bush himself, about making the removal of Saddam Hussein a top priority once they are in office. After the invasion of Iraq in March 2003, counterterrorism “tsar” Richard Clarke will say that the Bush team had been planning regime change in Iraq since before coming to office, with newly named Defense Secretary Donald Rumsfeld (see December 28, 2000) and his deputy Paul Wolfowitz (see January 11, 2001) taking the lead. “Since the beginning of the administration, indeed well before, they had been pressing for a war with Iraq,” he will write in his book Against All Enemies. “My friends in the Pentagon had been telling me that the word was we would be invading Iraq sometime in 2002.” [Clarke, 2004, pp. 7-9; Unger, 2007, pp. 192] During an appearance on Good Morning America on March 22, 2004, he will say, “[T]hey had been planning to do something about Iraq from before the time they came into office.” [Good Morning America, 3/22/2004] Evidence of pre-inaugural discussions on regime change in Iraq comes from other sources as well. Imam Sayed Hassan al-Qazwini, who heads the Islamic Center of America in Detroit, will tell the New York Times in early 2004 that he spoke with Bush about removing Saddam Hussein six or seven times, both before and after the 2000 elections. [New York Times, 1/12/2004] In 2007, author Craig Unger will write: “In certain respects, their actions were a replay of the 1976 Team B experiment (see Early 1976 and November 1976), with one very important difference. This time it wasn’t just a bunch of feverish ideologues presenting a theoretical challenge to the CIA. Incoming Vice President Dick Cheney is already working to formulate the new administration’s energy policy, and to do so he is calling on a variety of CEOs and lobbyists for the oil, gas, and energy corporations. Authors Lou Dubose and Jake Bernstein will later observe that Cheney’s “visitor log began to look like the American Petroleum Institute [API]‘s membership list. This was no coincidence.” In early January, an oil and gas lobbyist brings a group of industry executives to the API’s Washington offices to put together a wish list for Cheney and the administration. Shortly after the inauguration, the same lobbyist, J. Steven Griles, will be named deputy secretary of the interior and assigned to work with the Cheney energy task force (see May 16, 2001). Griles will become the conduit for API members to funnel their recommendations directly to the task force. [Dubose and Bernstein, 2006, pp. 7]

[Source: Washington Post]Vice President Cheney, having just taken the oath of office minutes before, has a brief discussion of his new position with former Vice President Dan Quayle, who had served under George H. W. Bush. In 2007, Quayle will recall the discussion: “I said, ‘Dick, you know, you’re going to be doing a lot of this international traveling, you’re going to be doing all this political fundraising… you’ll be going to the funerals.’ I mean, this is what vice presidents do. I said, ‘We’ve all done it.’” Cheney “got that little smile,” Quayle will recall, and replies, “I have a different understanding with the president.” Quayle adds, “He had the understanding with President Bush that he would be—I’m just going to use the word ‘surrogate chief of staff.’” Bush policy director Joshua Bolten will later say that Cheney wants, and is given, a mandate by Bush that gives him access to “every table and every meeting,” making his voice heard in “whatever area the vice president feels he wants to be active in.” [Washington Post, 6/24/2007]

According to reporter and author Charlie Savage, the White House staff quickly coalesces into two camps: “Bush People[,] mostly personal friends of the new president who shared his inexperience in Washington,” which includes President Bush’s top legal counsels, Alberto Gonzales and Harriet Miers, both corporate lawyers in Texas before joining Bush in Washington. The second group is “Cheney People—allies from [Vice-President Dick] Cheney’s earlier stints in the federal government (see May 25, 1975, November 18, 1980, 1981-1992, 1989, and June 1996) who were deeply versed in Washington-level issues, a familiarity that would allow their views to dominate internal meetings. These included [Defense Secretary Donald] Rumsfeld and other cabinet secretaries, key deputies throughout the administration, and David Addington, Cheney’s longtime aide who would become a chief architect of the administration’s legal strategy in the war on terrorism” (see July 1, 1992 and (After 10:00 a.m.) September 11, 2001). Savage will observe, “Given the stark contrast in experience between Cheney and Bush, it was immediately clear to observers of all political stripes that Cheney would possess far more power than had any prior vice president.”
'Unprecedented' Influence - Cheney will certainly have “unprecedented” influence, according to neoconservative publisher William Kristol, who himself had served as former Vice President Dan Quayle’s chief of staff. “The question to ask about Cheney,” Kristol will write, is “will he be happy to be a very trusted executor of Bush’s policies—a confidant and counselor who suggests personnel and perhaps works on legislative strategy, but who really doesn’t try to change Bush’s mind about anything? Or will he actually, substantively try to shape administration policy in a few areas, in a way that it wouldn’t otherwise be going?”
Expanding the Power of the Presidency - Cheney will quickly answer that question, Savage will write, by attempting to “expand the power of the presidency.” Savage will continue: “He wanted to reduce the authority of Congress and the courts and to expand the ability of the commander in chief and his top advisers to govern with maximum flexibility and minimum oversight. He hoped to enlarge a zone of secrecy around the executive branch, to reduce the power of Congress to restrict presidential action, to undermine limits imposed by international treaties, to nominate judges who favored a stronger presidency, and to impose greater White House control over the permanent workings of government. And Cheney’s vision of expanded executive power was not limited to his and Bush’s own tenure in office. Rather, Cheney wanted to permanently alter the constitutional balance of American government, establishing powers that future presidents would be able to wield as well.” [Savage, 2007, pp. 7-9] Larry Wilkerson, the chief of staff for Secretary of State Colin Powell, will say after leaving the administration: “We used to say about both [Defense Secretary Donald Rumsfeld’s office] and the vice president’s office that they were going to win nine out of 10 battles, because they were ruthless, because they have a strategy, because they never, never deviate from that strategy. They make a decision, and they make it in secret, and they make it in a different way than the rest of the bureaucracy makes it, and then suddenly, foist it on the government—and the rest of the government is all confused.” [Unger, 2007, pp. 299]
Signing Statements to Reshape Legislation, Expand Presidential Power - To that end, Cheney ensures that all legislation is routed through his office for review before it reaches Bush’s desk. Addington goes through every bill for any new provisions that conceivably might infringe on the president’s power as Addington interprets it, and drafts signing statements for Bush to sign. In 2006, White House counsel Bradford Berenson will reflect: “Signing statements unite two of Addington’s passions. One is executive power. And the other is the inner alleyways of bureaucratic combat. It’s a way to advance executive power through those inner alleyways.… So he’s a vigorous advocate of signing statements and including important objections in signing statements. Most lawyers in the White House regard the bill review process as a tedious but necessary bureaucratic aspect of the job. Addington regarded it with relish. He would dive into a 200-page bill like it was a four-course meal.” It will not be long before White House and Justice Department lawyers begin vetting legislation themselves, with Addington’s views in mind. “You didn’t want to miss something,” says a then-lawyer in the White House. Bush is sworn in after a tumultuous, sharply disputed election that ended with a US Supreme Court decision in his favor (see 9:54 p.m. December 12, 2000). He takes the oath of office on the same Bible his father, George H.W. Bush, used in his own 1989 inauguration; the oath is administered by Chief Justice William Rehnquist. In his brief inaugural address, delivered outside the US Capitol, Bush asks Americans to “a commitment to principle with a concern for civility.… Civility is not a tactic or a sentiment. It is the determined choice of trust over cynicism, of community over chaos.” In words apparently chosen to reflect on the criticisms surrounding former President Clinton and his notorious affair with White House intern Monica Lewinsky, Bush says, “I will live and lead by these principles—to advance my convictions with civility, to pursue the public interest with courage, to speak for greater justice and compassion, to call for responsibility, and try to live it as well.” He continues addressing the American people, saying: “I ask you to be citizens. Citizens, not spectators. Citizens, not subjects. Responsible citizens, building communities of service and a nation of character.” At a post-ceremonial luncheon, Bush issues a series of executive orders, some designed to block or roll back several Clinton-era regulations. He also acknowledges that because of the election turmoil, many Americans believe “we can’t get anything done… nothing will happen, except for finger-pointing and name-calling and bitterness.” He then says: “I’m here to tell the country that things will get done. Republicans and Democrats will come together to do what’s right for America.” [New York Times, 1/21/2001]
Thousands of Protesters - Thousands of protesters line the streets during Bush’s ceremonial drive to the Capitol, a fact not heavily reported by many press outlets. Salon reports, “Not since Richard Nixon paraded down Pennsylvania Avenue in 1973 has a presidential inauguration drawn so many protesters—and last time, people were out to protest the Vietnam War.” Though Capitol Police refuse to estimate the size of the crowd lining the street, Salon reports that “many thousands of protesters were in evidence.” Liz Butler of the Justice Action Movement, the umbrella organization that helped coordinate the protests, says: “The level of people on the streets shows that people are really upset about lack of democratic process. They took it to the streets. We saw tens of thousands. We saw far more protesting Bush than supporting him.” Some of the people on the streets are Bush supporters, but many more are not, and carry signs such as “Bush Cheated,” “Hail to the Thief,” “Bush—Racism,” “Bushwhacked by the Supremes,” and others. The crowd, though outspoken in its protests and unrestrained in its heckling of Bush and Vice President Dick Cheney, is generally peaceful, and no serious violence is reported, though a few minor altercations do take place, and large contingents of police in riot gear—including personnel from every police department in the District of Columbia as well as the Bureau of Alcohol, Tobacco and Firearms and from departments in Maryland and Virginia—are on hand. At least one protester throws an egg at the limousine transporting Bush, Cheney, and their families to the inaugural ceremonies; perhaps in response to the protests, Bush breaks with tradition laid down by earlier presidents and does not walk any large portion of the parade route. Nine people are arrested for disorderly conduct, most for allegedly throwing bottles and other debris. Bulter says: “Of course, we’re ashamed that Bush has decided to be a ‘uniter’ by uniting people against him. They all chose to come out in the freezing rain—even the weather couldn’t stop these people.” Protester Mary Anne Cummings tells a reporter: “I think it’s important to remind the incoming administration the country does not want a right-wing mandate. They did not vote for a right-wing mandate.” [Salon, 1/20/2001; CNN, 1/20/2001; New York Times, 1/21/2001] Thousands of protesters march in San Francisco, Los Angeles, and other cities as well. The Bush administration broadens the definition of what the government considers classified information from the very beginning of its time in office. Author Ron Suskind will later write, “The [classification] initiative was a pet project of [Vice President Cheney], who’d long believed that public and congressional scrutiny of presidents was weakening executive power. With Cheney’s guidance [before 9/11], documents were being classified at twice the rate of the previous administration.” This penchant for secrecy and classification will increase even more after 9/11. National Security Adviser Condoleezza Rice later testifies to the 9/11 Commission that in the first eight months of Bush’s presidency before 9/11, “the president receive[s] at these [Presidential Daily Briefings] more than 40 briefing items on al-Qaeda, and 13 of those [are] in response to questions he or his top advisers posed.” [Washington Post, 4/8/2004] The content of the warnings in these briefings are unknown. However, CIA Director George Tenet claims that none of the warnings specifically indicates terrorists plan to fly hijacked commercial aircraft into buildings in the US. [New York Times, 4/4/2004] Counterterrorism “tsar” Richard Clarke will later emphasize, “Tenet on 40 occasions in… morning meetings mentioned al-Qaeda to the president. Forty times, many of them in a very alarmed way, about a pending attack.” [Vanity Fair, 11/2004] These briefings are normally given in person by CIA Director George Tenet, and are usually attended by Vice President Cheney and National Security Adviser Rice. In the Clinton administration, up to 25 officials recieved the PDB. But in the Bush adminisration before 9/11, this was sharply reduced to only six people (see After January 20, 2001). Other top officials have to make due with an Senior Executive Intelligence Brief generally released one day later, which is similar to the PDB but often contains less information (see August 7, 2001). Numerous figures in Bush’s administration have been directly employed in the oil industry, including Bush, Vice President Cheney, and National Security Adviser Rice. Vice President Cheney takes office with every intention to push President Bush into invading Iraq. According to an unnamed former subordinate of Cheney’s while Cheney was secretary of defense (see March 20, 1989 and After), Cheney wants to “do Iraq” because he thinks it can be done quickly and easily, and because “the US could do it essentially alone… and that an uncomplicated, total victory would set the stage for a landslide re-election in 2004 and decades of Republican Party domination.” Cheney believes that overthrowing Saddam Hussein “would ‘finish’ the undone work of the first Gulf War and settle scores once and for all with a cast of characters deeply resented by the vice president: George H. W. Bush, Colin Powell, Brent Scowcroft, and Jim Baker.” [Unger, 2007, pp. 182]

The Bush administration’s legal team meets for the first time. The head of the group, White House counsel Alberto Gonzales, is well known as a staunchly loyal aide to President Bush, and has long ensured that Bush receives the legal opinions he wants. While Bush was governor of Texas, Gonzales routinely prepared briefings for him on death row prisoners appealing for clemency, briefings that usually left out mitigating circumstances that might have led Bush to consider waiving the death penalty. Bush was pleased at Gonzales’s approach, and the White House legal team will quickly come to understand that that same approach will be used in its legal work. One young team member is Bradford Berenson, who made his reputation working with the Bush-Cheney campaign in its fight to win the disputed 2000 presidential election. Berenson is one of eight White House associate counsels. Gonzales tells the gathered counsels and legal staff that most of their work will be in handling the everyday legal tasks generated by the White House, reviewing speeches and letters, making judgments on ethical issues, and the like. But, according to Gonzales, Bush has personally instructed him to give his team two missions as their top priority.
Appoint Conservatives to Judiciary Positions - One is to find as many conservatives as they can to fill the numerous vacancies on the federal courts, vacancies left unfilled because of Senate Republicans’ refusal to schedule hearings for Clinton nominees. Now, Gonzales tells the legal team, they are to find as many conservative “judicial restraint”-minded lawyers as there are judgeships to be filled, and to get them confirmed as quickly as possible. This is an unsurprising mission, as most in the room expect the Republicans to lose control of Congress in 2002—as, historically, most parties who control the executive branch do in midterm elections—and therefore have only a limited time in which to get nominees named, vetted, and confirmed by friendly Congressional Republicans.
Find Ways to Expand Presidential Power - Gonzales’s second mission is more puzzling. The lawyers are to constantly look for ways to expand presidential power, he tells them. Bush has told his senior counsel that under previous administrations, the power of the presidency has eroded dramatically. (Ironically, some of the losses of executive power came due to the Republican-led investigation of former President Clinton’s involvement in Whitewater and his affair with a White House intern, when Secret Service bodyguards and White House attorneys were compelled to testify about their communications with the president, and Congressional Republicans issued subpoenas and demanded information from the White House.) It is time to turn back the tide, Gonzales tells his team, and not only regain lost ground, but expand presidential power whenever the opportunity presents itself. Berenson will later recall Gonzales telling them that they are “to make sure that [Bush] left the presidency in better shape than he found it.” Berenson will later remark: “Well before 9/11, it was a central part of the administration’s overall institutional agenda to strengthen the presidency as a whole. In January 2001, the Clinton scandals and the resulting impeachment were very much in the forefront of everyone’s mind. Nobody at that point was thinking about terrorism or the national security side of the house.” Berenson does not learn until much later that much of the direction they have received has come, not from President Bush, but from Vice President Cheney and his legal staff, particularly his chief counsel, David Addington. White House counterterrorism “tsar” Richard Clarke meets with President Bush and others to discuss the administration’s approach to cyber-security and terrorism. Clarke will later express his surprise at the way Bush conducts himself: “We had a couple of meetings with the president, and there were detailed discussions and briefings on cyber-security and often terrorism, and on a classified program. With the cyber-security meeting, he seemed—I was disturbed because he seemed to be trying to impress us, the people who were briefing him. It was as though he wanted these experts, these White House staff guys who had been around for a long time before he got there—didn’t want them buying the rumor that he wasn’t too bright. He was trying—sort of overly trying—to show that he could ask good questions, and kind of yukking it up with [Dick] Cheney. The contrast with having briefed his father [George H. W. Bush] and [Bill] Clinton and [Al] Gore was so marked. And to be told, frankly, early in the administration, by Condi Rice and [her deputy] Steve Hadley, you know, ‘Don’t give the president a lot of long memos, he’s not a big reader’—well, sh_t. Two of the first people to meet with the newly inaugurated President Bush are Enron CEO Kenneth Lay and Enron vice president Robert Shapiro. Lay and Shapiro are close political allies of Bush and Vice President Cheney. Lay and his Enron executives were not only the largest campaign donors for the Bush-Cheney presidential effort, but are Bush’s largest lifetime political backers, having financed Bush’s two campaigns for governor of Texas to the tune of some $775,000. Enron sank $1.2 million into the various 2000 Republican political campaigns, with the lion’s share of those donations going to the Bush-Cheney campaign. Enron provided more tangible support than just money; during the contentious December 2000 recount debacle in Florida, Enron (and Halliburton) provided corporate jets that shuttled Bush-Cheney lawyers and personnel around Florida and Washington. Online columnist Rich Galen, a former Republican strategist who has numerous contacts within the new Bush administration, reports: “Vice President Dick Cheney’s staffers trying to move into the Office of the Vice President space in the Old Executive Office Building right next to the White House found the offices had been left in complete shambles by the Gore staff on its way out on Friday and Saturday (see January 23, 2001). Every cord and wire, in many offices—telephone, power, computer, and lamp—was slashed. Furniture was tossed, and trash was, literally, everywhere. One person [told Galen] that it was his understanding that Mrs. Gore [the wife of former Vice President Gore] had to phone Mrs. Cheney to apologize.” [Mullings, 1/24/2001] Conservative gossip writer Matt Drudge uses Galen’s column and his own White House sources to report that, according to a “close Bush adviser,” the damage went “way beyond pranks, to vandalism.” The Los Angeles Times soon debunks the story of the Gore apology by asking the Gores; Vice President Cheney will also say that the phone call never happened. The Washington Post reports that the US has confirmed the link between al-Qaeda and the October 2000 USS Cole bombing (see October 12, 2000). [Washington Post, 1/27/2001] This conclusion is stated without hedge in a February 9 briefing for Vice President Cheney. [Washington Post, 1/20/2002] In the wake of that bombing, Bush stated on the campaign trail, “I hope that we can gather enough intelligence to figure out who did the act and take the necessary action.… There must be a consequence.” [Washington Post, 1/20/2002] Deputy Defense Secretary Paul Wolfowitz later complains that by the time the new administration is in place, the Cole bombing was “stale.” Defense Secretary Rumsfeld concurs, stating that too much time had passed to respond. [9/11 Commission, 3/24/2004] The new Bush administration fails to resume the covert deployment of cruise missile submarines and gunships on six-hour alert near Afghanistan’s borders that had begun under President Clinton. The standby force gave Clinton the option of an immediate strike against targets in Afghanistan harboring al-Qaeda’s top leadership. President Bush informs a small group of reporters that he is forming an “energy task force” to draw up a new national energy policy. It will be the first major policy initiative of his presidency. The administration is driven by its concern for “the people who work for a living… who struggle every day to get ahead.” The task force will find ways to meet the rising demand for energy and to avoid the shortfalls causing major power blackouts in California and other areas (see January 23, 2001). He has chosen Vice President Cheney to chair the task force. “Can’t think of a better man to run it than the vice president,” he says. He refuses to take questions, turning aside queries with jokes about the recent Super Bowl. The short press briefing will be virtually the only time the White House tells reporters anything about Cheney’s National Energy Policy Development Group. [Savage, 2007, pp. 85-86] Deputy press secretary Scott McClellan will later write that the task force “held a series of meetings with outside interests whose identities were withheld from the public. This created an early impression of an administration prone to secrecy and reinforced the image of the Bush White House as in thrall to corporate interests.” [McClellan, 2008, pp. 96]

[Source: Minaret of Freedom Institute] (click image to enlarge)Hundreds of the world’s most extreme Islamic militants attend an unprecedented conference in Beirut, Lebanon called “The First Conference on Jerusalem.” Participants include leaders of al-Qaeda, Hamas, Islamic Jihad, Hezbollah, and militants from Egypt, Pakistan, Jordan, Algeria, Sudan, Qatar, and Yemen. The conference is held with the purpose of uniting militant groups for holy war against Israel and the US. The participants create a new organization called “the Jerusalem Project,” with the goal of winning total Muslim control over Jerusalem. The participants produce a document which calls for a boycott on US and Israeli products and states, “The only decisive option to achieve this strategy [to regain Jerusalem] is the option of jihad [holy war] in all its forms and resistance… America today is a second Israel.” [Jerusalem Post, 6/22/2001; Fox News, 5/17/2002] At least four of the attendees come from the US. One of them, Abdurahman Alamoudi, is a prominent lobbyist in the US for Muslim causes. Yet there is no indication Alamoudi faces any investigation in the US after attending this conference. In fact, in June 2001, Alamoudi will apparently take part in a meeting with Vice President Cheney at the White House for a briefing on the Bush administration’s domestic and foreign policies of interest to the American Muslim community. [Jerusalem Post, 6/22/2001; St. Petersburg Times, 3/11/2003; Minaret of Freedom Institute, 2/8/2005] Another participant in the conference is Ahmad Huber, a director of the Al Taqwa Bank, which will be shut down in the months after 9/11 for suspected terrorism ties. Huber is known for his connections to both neo-Nazi and radical Muslim groups (see 1988). After 9/11, Huber will claim that he met some al-Qaeda leaders in this conference and will praise them for being “very discreet, well-educated, and very intelligent people.” [Financial Times, 11/8/2001; Playboy, 2/1/2002] Huber says that in the five years before 9/11, the bin Laden family sponsors Al Taqwa’s attendance at several international Muslim conferences, possibily including this one. He nonetheless claims the family is estranged from Osama bin Laden. [Le Monde (Paris), 5/3/2002] It has not been reported if Alamoudi met with Huber or any al-Qaeda leaders while at the conference. Alamoudi will later be sentenced to 23 years in prison in the US for illegal dealings with Libya (see October 15, 2004).

The bipartisan panel was put together in 1998 by then-President Bill Clinton and then-House Speaker Newt Gingrich. Hart and Rudman personally brief National Security Adviser Condoleezza Rice, Defense Secretary Donald Rumsfeld, and Secretary of State Colin Powell on their findings. The report has 50 recommendations on how to combat terrorism in the US, but all of them are ignored by the Bush administration.
Shelved by White House - According to Hart, Congress will begin to take the commission’s suggestions seriously in March and April, and legislation is introduced to implement some of the recommendations. Then, “Frankly, the White House shut it down.… The president said, ‘Please wait, we’re going to turn this over to the vice president‘… and so Congress moved on to other things, like tax cuts and the issue of the day.” The White House will announce in May that it will have Vice President Dick Cheney study the potential problem of domestic terrorism, despite the fact that this commission had just studied the issue for 2 1/2 years. Interestingly, both this commission and the Bush administration were already assuming a new cabinet level National Homeland Security Agency would be enacted eventually, even as the public remained unaware of the term and the concept. Cannot Get Meeting with Bush - At the meeting with Rice, Rudman says he wants to see President Bush, and is planning to deliver a “blunt and very direct” warning to him that he needs to deal early in his presidency with the question of domestic terror threats. Rice initially agrees to pass on Rudman’s request for a meeting with Bush, but nothing happens. Rudman will contact Rice’s office several times, but still no meeting is arranged. Rudman will later say he is “disappointed” by this, adding, “There’s no question in my mind that somebody at the White House dropped the ball on this.” [Shenon, 2008, pp. 56-57]
Ignored by 9/11 Commission - Hart will be incredulous that neither he nor any of the other members of this commission are ever asked to testify before the 9/11 Commission. [Salon, 4/6/2004] The 9/11 Commission will later make many of the same recommendations as this commission. However, it will barely mention the Hart/Rudman Commission in its final report, except to note that Congress appointed it and failed to follow through on implementing its recommendations. An unnamed high-level National Security Council (NSC) official writes a memo to the NSC staff, advising it to cooperate with Cheney’s newly formed Energy Task Force. According to the memo, Cheney’s group is “melding… the review of operational policies towards rogue states” with “actions regarding the capture of new and existing oil and gas fields.” [New Yorker, 2/16/2004] The task force was put together during the transition between administrations, so it hit the ground running by the end of January. [Dean, 2004, pp. 76] Former Nixon White House counsel John Dean will write in 2004, “Cheney’s energy group, and its recommendations, was about as ‘responsive’ as a White House can be to big contributors without using the words quid pro quo—which is the essence of bribery. Starting at this time, Enron leader Ken Lay and other Enron officials take part in a least half a dozen of these secret meetings. After one such meeting, Cheney’s energy task force changes a draft energy proposal to include a provision boosting oil and natural gas production in India. The National Security Agency (NSA) engages in apparently illegal surveillance of US citizens beginning shortly after the inauguration of George W. Bush as president. This will not be revealed to the public until media reports in January 2006, a month after the press revealed that the NSA had engaged in similar illegal wiretaps and surveillance of American citizens after the 9/11 attacks, using those attacks as justification for the surveillance (see December 15, 2005). The former NSA and counterterrorism officials who reveal the pre-9/11 spying will claim that the wiretaps, e-mail monitoring, and Internet surveillance were all “inadvertent,” as NSA computers “unintentionally” intercepted US citizens’ international phone calls and e-mails when the computers flagged keywords. NSA protocol demands that such “inadvertent” surveillance end as soon as NSA analysts realize they are spying on those citizens, and the names of the monitored citizens are supposed to be deleted from the NSA databases. Instead, the NSA is instructed to continue monitoring some citizens that are characterized as “of interest” to White House officials. Those officials include President Bush, Vice President Cheney, and Defense Secretary Donald Rumsfeld, say the former NSA and counterterrorism officials. In December 2000, the NSA told the incoming Bush administration that some US citizens are being inadvertently targeted for surveillance, but the names of the citizens are deleted because the law expressly prohibits the NSA from spying on US citizens, US corporations, or even permanent US residents (see December 2000). However, once Bush takes office in January 2001, that practice undergoes a radical change. In the first few months of the administration, President Bush assigns Vice President Cheney to make himself more of a presence at the various US intelligence agencies, particularly the CIA, NSA, and DIA. Cheney, along with other officials at the State and Defense Departments, begins making repeated requests to the NSA to reveal the identities of those Americans which had previously been deleted, so that administration officials can more fully understand the context and scope of the intelligence. Such requests are technically legal. But Cheney goes well beyond the law when he requests, as he frequently does, that the NSA continue monitoring specific Americans already caught up in the NSA’s wiretaps and electronic surveillance. A former White House counterterrorism official will later claim that Cheney advised Bush of what he was learning from the NSA. “What’s really disturbing is that some of those people the vice president was curious about were people who worked at the White House or the State Department,” says another former counterterrorism official. “There was a real feeling of paranoia that permeated from the vice president’s office and I don’t think it had anything to do with the threat of terrorism. I can’t say what was contained in those taps that piqued his interest. I just don’t know.” [Truthout (.org), 1/17/2006]

In a 2007 interview with radio show host Jon Elliot, Clarke says: “Prior to 9/11 a number of people in the White House were saying to me you know this—this administration, particularly Cheney, but also Bush [and] people like Wolfowitz in the Pentagon, are really intent on going to war with Iraq. And this was the whispered conversations in the National Security Council staff.… Early, early on in the administration people I knew and trusted in the administration were saying to me, ‘You know. They’re really going to do it. They are going to go to war with Iraq.’ And I was flabbergasted. Why would you want to do that of all the things in the world that one could choose to do?… And how are we going to do it? How are we going to cause that provocation? The task force’s coal policy recommendations will directly impact the stock market’s response to Peabody’s IPO. The task force releases its recommendations (see May 16, 2001) less than a week before Peabody releases its stock offering on May 21. In part because the energy policy strongly emphasizes the use of coal, Peabody raises $420 million by going public—$60 million more than stock analysts predicted. President George Bush, following the lead of Vice President Dick Cheney, prepares to renege on his campaign promise to cap carbon dioxide emissions (see September 29, 2000, March 8, 2001, and March 13, 2001). The promise is later described by authors Lou Dubose and Jake Bernstein as “the environmental centerpiece of [his] presidential campaign.” Christine Todd Whitman, the head of the Environmental Protection Agency, later says on CNN, “George Bush was very clear during the course of the campaign that he believed in a multipollutant strategy, and that includes CO2.” Initially, Bush stood by his pledge even as House Republicans Tom DeLay (R-TX) and Joe Barton (R-TX) attacked it as being bad for business. But on March 1, Cheney receives a personal note from energy lobbyist and veteran Republican operative Haley Barbour, headed “Regarding Cheney Energy Policy & Co.” The note reads in part: “A moment of truth is arriving in the form of a decision whether this administration’s policy will be to regulate and/or tax CO2 as a pollutant.… Demurring on the issue of whether the CO2 idea is eco-extremism, we must ask, do environmental initiatives, which would greatly exacerbate the energy problems, trump good energy policy, which the country has lacked for eight years?” Cheney moves quickly to respond to Barbour’s concerns. Kim Jong Il and Kim Dae Jung.Kim Jong Il and Kim Dae Jung. [Source: Encyclopedia Brittanica]President Bush meets with South Korean president Kim Dae Jung (known in the administration as KDJ), and pointedly snubs Kim in an official press conference, announcing that he has no intention of following the Clinton policy of engaging North Korea in any sort of dialogue regarding North Korea’s nuclear buildup. Kim has attempted to implement a “sunshine” policy of open negotiations with the North, including economic trade and nuclear talks, but his efforts are predicated on US support. Secretary of State Colin Powell advocates working with Kim to further implement negotiations with North Korea, but loses out (see March 7, 2001) to pressure from Vice President Dick Cheney, Defense Secretary Donald Rumsfeld, and Rumsfeld’s deputy, Paul Wolfowitz, who believe Clinton had been doing little more than appeasing a tyrant in negotiating with North Korea’s Kim Jong Il. Bush misstates the facts in the conference, saying that “we’re not certain as to whether or not they’re keeping all terms of all agreements,” when there has only been a single agreement between the US and North Korea, the 1994 agreement to freeze North Korea’s plutonium processing (see October 21, 1994). Treasury Secretary Paul O’Neill believes that the gaffe is due to Bush’s lack of understanding of the complex situation between the US, North Korea, and the US’s allies in Southeast Asia, and Bush’s failure to “do his homework” before Kim’s arrival in Washington. O’Neill attempts to salvage the situation by lauding South Korea’s superb literacy rate among its citizens, earning a look of surprise from Bush. O’Neill privately mulls over the decision-making process in the White House, with Bush damaging ten years of “delicately stitched US policy towards North Korea” in just a few minutes. [Suskind, 2004, pp. 114-115] In 2004, foreign affairs reporter Fred Kaplan will offer an explanation of Bush’s behavior. To negotiate with an “evil regime” such as North Korea’s is, in Bush’s view, “to recognize that regime, legitimize it, and—if the negotiations led to a treaty or a trade—prolong it.” Bush has already told one reporter that he “loathed” Kim Jong Il. He distrusts anyone such as KDJ who has any intention of accomodating or even negotiating with such a regime. Additionally, Bush views the South Korean leader—a democratic activist who had spent years in prison for his beliefs—with what Kaplan calls “startling contempt.” Charles “Jack” Pritchard, who had been director of the National Security Council’s Asia desk under Clinton and is now the State Department’s special North Korean envoy under Bush, will later recall, “Bush’s attitude toward KDJ was, ‘Who is this naive, old guy?’” Bush and his advisers, particularly Rumsfeld and Cheney, hope not only to isolate North Korea, but to undermine Kim Dae Jung’s regime in hopes to shake his administration and drive South Koreans to elect a conservative in the next elections. An angry and embarrassed Christine Todd Whitman, the director of the Environmental Protection Agency (EPA), storms into a breakfast meeting with Treasury Secretary Paul O’Neill, waving a letter signed by four Republican senators—Chuck Hagel (R-NE), Larry Craig (R-ID), Jesse Helms (R-NC), and Pat Roberts (R-KS). The letter says that President Bush will soon withdraw the US from the Kyoto Accords (see March 27, 2001), even though Whitman has been telling the press Bush is committed to a “multipollutant” strategy of reducing CO2 and other emissions. Worse, Bush is going to renege on his promise to reduce C02 emissions (see September 29, 2000). O’Neill, who is until now unaware of the backchannel discussions about the administration’s environmental policy, is suspicious of the tone and language of the letter, which was faxed from Hagel’s office two days before. It sounds, he later writes, as if it came “right out of Dick Cheney’s mouth” (see March 1, 2001). O’Neill will later learn that Hagel and Cheney had been working for days to reverse Bush’s course on carbon dioxide caps, and in the process undermine Whitman (see March 8, 2001 and March 13, 2001). Disturbed by President Bush’s impending reversal of his pledge to cap carbon dioxide emissions (see September 29, 2000), Environmental Protection Agency head Christine Todd Whitman meets with Bush to attempt to change his mind. But Bush cuts her off: “Christine, I’ve already made my decision.” He says he has written a letter to Senator Chuck Hagel (R-NE—see March 13, 2001). Notably, as Whitman is leaving the Oval Office, she sees Vice President Cheney pick up the letter to Hagel from a secretary (see March 8, 2001). That same day, Cheney meets with Hagel and then addresses the Senate Republican Conference, announcing to that body that the administration no longer supports carbon dioxide caps. Treasury Secretary Paul O’Neill later calls Cheney’s actions “a clean kill,” reminiscent of the bureaucratic manipulations Cheney had become so good at during the Nixon and Ford administrations. Representatives of 13 environmentalist groups meet with officials from Vice President Cheney’s energy task force (the National Energy Policy Development Group—see May 16, 2001). Since late January, some 40 task force meetings have been held, all with oil and energy company executives and lobbyists (see Before January 20, 2001, After January 20, 2001, Mid-February, 2001, Mid-February, 2001, March 5, 2001, March 20, 2001, March 21, 2001, March 22, 2001, April 12, 2001. April 17, 2001, and April 17, 2001 and After). Today is the one day where environmental groups are allowed to have any input. Anna Aurilio of the US Public Interest Group will later say, “It was clear to us that they were just being nice to us.” (Notably, the only people ever identified as “lobbyists” by the task force to the press are the representatives from the environmental groups from today’s meeting.) Their input is neither wanted nor used; an initial draft of the task force’s report has already been prepared and President Bush has already been briefed on its contents. The names of the various officials, executives, lobbyists, and representatives who meet with the task force will not be released for six years (see July 18, 2007). Negotiations and disputes over the collision and subsequent crash of a US spy plane and a Chinese fighter jet over Chinese waters continue (see March 31, 2001, April 4-5, 2001, and April 6-7, 2001). US officials warn long-term relations are at risk because of the dispute; Vice President Dick Cheney insists the US will not apologize over the incident. President Bush sends an unsigned letter to the wife of the slain Chinese pilot, Wang Wei, that expresses his “regret” over his death. A report commissioned by former US Secretary of State James Baker and the Council on Foreign Relations, titled “Strategic Energy Policy Challenges For The 21st Century,” is completed and submitted to Vice President Dick Cheney. The report was drafted by the James A. Baker III Institute for Public Policy. Edward L. Morse, an energy industry analyst, chaired the project, and Amy Myers Jaffe was the project’s director. The paper urges the US to formulate a comprehensive, integrated strategic energy policy to address the current energy crisis, which it attributes to infrastructural restraints, rapid global economic expansion, and the presence of obstacles to foreign investment in the oil-rich Middle East. The report says the world’s supply of oil is not a factor in the crisis. “The reasons for the energy challenge have nothing to do with the global hydrocarbon resource base…. The world will not run short of hydrocarbons in the foreseeable future,” the paper says. One of the report’s recommendations is to “[r]eview policies toward Iraq” with the ultimate goal of stemming the tide of anti-Americanism in the Middle-East and “eas[ing] Iraqi oil-field investment restrictions.” Iraq, under the leadership of Saddam Hussein, remains a “destabilizing influence… to the flow of oil to international markets from the Middle East.” It also notes, “Saddam Hussein has also demonstrated a willingness to threaten to use the oil weapon and to use his own export program to manipulate oil markets.” Therefore, the report says, the “United States should conduct an immediate policy review toward Iraq, including military, energy, economic, and political/diplomatic assessments” and work with key allies to develop a new integrated strategy toward Iraq. Key elements of the new policy should include narrowing the focus of sanctions and using diplomatic means to enforce existing UN resolutions. Vice President Cheney meets with Enron CEO Kenneth Lay as part of Cheney’s secretive energy task force (the National Energy Policy Development Group—see May 16, 2001). Though Cheney may not know it, Enron is on the verge of collapse, with liabilities far outweighing assets and heavily doctored earnings statements. Enron’s only income generation comes from the unregulated energy markets in California and other Western states (see January 23, 2001). Enron traders are gouging the California markets at an unprecedented pace; as authors Lou Dubose and Jake Bernstein later write, Enron is “taking power plants off-line to create shortages, booking transmission lines for current that never move[s], and shuttling electricity back and forth across state lines to circumvent price controls,” among a plethora of other illegal market manipulations.
Ignoring California's Energy Crisis - Unable to make a profit between buying Enron’s energy at staggering prices and then selling it at regulated rates, one of California’s two largest utility companies has filed for bankruptcy and the other has accepted a government bailout. California is in a calamitous energy crisis. Governor Gray Davis is pleading for rate caps that would help both utility companies and consumers. But price caps are the last thing Lay wants. Once in Cheney’s office, Lay gives Cheney a three-page memo outlining Enron’s recommendations for the administration’s national energy policy Cheney’s group is developing. Prominently featured in the memo is the following recommendation: “The administration should reject any attempt to deregulate wholesale power markets by adopting price caps.” Almost every recommendation in the Lay memo will find its way into the energy task force’s final report. Cheney may not know that Enron is in such dire financial straits, but he does know that energy prices in California have gone from $30 to $300 per megawatthour, with periodic jumps to as high as $1,500. He also knows that Enron’s profits in California, along with other power producers, have gone up 400% to 600%.
Price Caps in Spite of Lay, Cheney - Lay does not get his way; the Federal Energy Regulatory Commission will override Cheney’s arguments and impose price caps on energy traders working in California. The state’s energy prices are brought under control, Enron’s trading schemes—luridly given such sobriquets as “Death Star,” “Fat Boy,” and “Get Shorty”—are brought to an end, and Enron collapses six months later (see December 2, 2001). Cheney will have a measure of revenge by forcing one of Lay’s adversaries on FERC, Curtis Hebert, out of his position (see August 14, 2001).
Avoiding Scrutiny and Oversight - This meeting and others are cleverly designed to avoid legal government oversight. According to the Federal Advisory Committees Act (FACA), the energy task force should be subject to public accountability because private parties—in this case, oil and gas industry executives and lobbyists—are helping shape government policy. Cheney’s legal counsel, David Addington, devises a simple scheme to avoid oversight. When a group of corporate lobbyists come together to create policy, a government official is present. Suddenly, FACA does not apply, and the task force need not provide any information whatsoever to the public. Dubose and Bernstein will later write: “It was bold as [artist] Rene Magritte’s near-photographic representation of a pipe over the inscription ceci n’est pas une pipe—‘this is not a pipe.’ Fifteen oil industry lobbyists meet in the Executive Office Building and one midlevel bureaucrat from the Department of Energy steps into the room—and voila, ceci n’est pas une foule de lobbyists. Because one government employee sat in with every group of lobbyists, a committee of outside advisers was not a committee of outside advisers.” Between Addington’s bureaucratic end-around and Cheney’s chairmanship of the working group giving the entire business the cloak of executive privilege, little information gets out of the group. “The whole thing was designed so that the presence of a government employee at a meeting could keep the Congress out,” a Congressional staff lawyer later says. George Skelton, a reporter for the Los Angeles Times, gets an unexpected call asking if he wants to interview Vice President Cheney. Skelton thinks the call might be to lay some groundwork for the 2004 Bush-Cheney re-election campaign. But Cheney wants to talk energy. Skelton is happy to oblige: energy prices are out of control in California. Cheney doesn’t just want to talk energy, though, he wants to talk about how bad an idea price caps are (see April 17, 2001 and After). “Price caps provide short-term relief for politicians,” Cheney says, in an oblique swipe at California’s Democratic governor, Gray Davis. He continues, “But they do nothing to deal with the basic, fundamental problem.” Skelton asks if the administration will support temporary price caps to get California through the immediate crisis period, and Cheney replies: “Six months? Six years? Once politicians can no longer resist the temptation to go with price caps, they usually are unable to muster the courage to end them.… I don’t see that as a possibility.” Cheney goes on: “Frankly, California is looked on by many folks as a classic example of the kinds of problems that arise when you do use price caps.” What Skelton does not know is that Cheney is echoing the recommendations of Enron CEO Kenneth Lay, whose company is primarily responsible for the California energy crisis. House Democrats Henry Waxman (D-CA) and John Dingell (D-MI) write to Andrew Lundquist, the executive director of the Cheney energy task force (see January 29, 2001), asking for access to the task force’s records. Waxman and Dingell ask with whom the task force met and what had been said at those meetings. They base their request on the 1972 Federal Advisory Committee Act (FACA), an open-government law that states when nongovernment officials, such as energy company officials or lobbyists, help craft public policy, the government must ensure that a balance of viewpoints is represented and such meetings must be open to the press and the public. Two weeks later, Cheney’s chief counsel, David Addington, replies, denying Waxman and Dingell any information. Addington says that FACA does not apply to the task force, and attaches a memo from Lundquist asserting that while nongovernmental officials have been part of the task force’s deliberations, since they were not official members of the task force, their participation does not count. “These meetings… were simply forums to collect individuals views rather than to bring a collective judgment to bear,” Addington writes. The next day, a Senior Executive Intelligence Brief (SEIB) with the title “Bin Laden Planning Multiple Operations” is sent to top White House officials. At the Associated Press’s annual meeting, Vice President Dick Cheney says the US needs to add another 1,300 to 1,900 new power plants to the country’s energy infrastructure over the next 20 years. He calls for the building of nuclear power plants and more coal-fired power plants that use clean technologies. Nuclear power is one of “the cleanest methods of power generation that we know,” he says. “If we’re serious about environmental protection, then we must seriously question the wisdom of backing away from what is, as a matter of record, a safe, clean, and very plentiful energy source.” On the issue of energy conservation, which some believe should be a core component of any plan aimed at reducing carbon emissions and US dependency on foreign oil, Cheney says, “To speak exclusively of conservation is to duck the tough issues. The Bush administration finally has its first Deputy Secretary-level meeting on terrorism. [Time, 8/12/2002] According to counterterrorism “tsar” Richard Clarke, he advocates that the Northern Alliance needs to be supported in the war against the Taliban, and the Predator drone flights need to resume over Afghanistan so bin Laden can be targeted. [Clarke, 2004, pp. 231] Deputy Defense Secretary Paul Wolfowitz says the focus on al-Qaeda is wrong. He states, “I just don’t understand why we are beginning by talking about this one man bin Laden,” and “Who cares about a little terrorist in Afghanistan?” Wolfowitz insists the focus should be Iraqi-sponsored terrorism instead. He claims the 1993 attack on the WTC must have been done with help from Iraq, and rejects the CIA’s assertion that there has been no Iraqi-sponsored terrorism against the US since 1993 (see April 30, 2001). The General Accounting Office (GAO), the nonpartisan investigative arm of Congress, sends David Addington, the chief counsel to Vice President Cheney, a letter declaring that it intends to review the composition and activities of Cheney’s energy task force (see January 29, 2001). Addington is the one who issued the flat refusal to allow members of Congress to see any of the minutes or documents generated by the task force (see April 19 - May 4, 2001); in response, the members of Congress who requested the information asked GAO chief and comptroller general David Walker for help in investigating the task force. Walker is quite bipartisan, having worked for the Reagan and Bush-Quayle administrations before being appointed to the chairmanship of the GAO by President Clinton. [Savage, 2007, pp. 88] Addington will reply to Walker, denying that the GAO has any authority to investigate the task force (see May 16 - 17, 2001). [Source: CNN]In a brief statement, President Bush announces that Vice President Dick Cheney will oversee a “coordinated national effort” aimed at integrating the government’s plans for responding to the use of a chemical, biological, radiological, or nuclear weapon within the United States. Bush declares, “Should our efforts to reduce the threat to our country from weapons of mass destruction be less than fully successful, prudence dictates that the United States be fully prepared to deal effectively with the consequences of such a weapon being used here on our soil.” Bush says a new agency within the Federal Emergency Management Agency (FEMA), known as the Office of National Preparedness, will be “responsible for implementing the results of those parts of the national effort overseen by Vice President Cheney that deal with consequence management.” The Office of National Preparedness appears to be a reincarnation of FEMA’s old National Preparedness Directorate (NPD), which was disbanded by the Clinton administration in 1993 (see January 1993-October 1994). During the 1980s and early 1990s, the NPD secretly spent billions of dollars preparing for nuclear war and other national emergencies as part of the highly classified Continuity of Government (COG) program (see February 1993, 1982-1991, and April 1, 1979-Present). [Cox News Service, 2/22/1993] Under the Bush administration, the Office of National Preparedness (ONP) will apparently take over where the National Preparedness Directorate left off. According to Bush, the ONP “will coordinate all Federal programs dealing with weapons of mass destruction consequence management within the Departments of Defense, Health and Human Services, Justice, and Energy, the Environmental Protection Agency, and other federal agencies.” Cheney, who played a central role in the COG program during the Reagan administration (see 1981-1992 and 1980s), informs CNN, “[O]ne of our biggest threats as a nation” could be “domestic terrorism, but it may also be a terrorist organization overseas or even another state using weapons of mass destruction against the US.… [W]e need to look at this whole area, oftentimes referred to as homeland defense.” According to FEMA, the ONP will be up and running as early as the summer of 2001. President Bush says he “will periodically chair a meeting of the National Security Council to review these efforts.” [CNN, 5/8/2001; White House, 5/8/2001; New York Times, 7/8/2002] Cheney is meant to head a group that will draft a national terrorism response plan by October 1. [Chicago Sun-Times, 5/5/2001; Insight on the News, 6/18/2001] But, according to Barton Gellman of the Washington Post, “Neither Cheney’s review nor Bush’s took place.” [Washington Post, 1/20/2002] Former Senator Gary Hart (D-CO) later implies that Bush assigned this specific role to Cheney in order to prevent Congress from enacting counterterrorism legislation proposed by a bipartisan commission he had co-chaired in January (see January 31, 2001). The General Accounting Office (GAO) tries five times to arrange a meeting with David Addington, the chief counsel for Vice President Cheney, regarding the GAO’s request for information about Cheney’s secret energy task force (see January 29, 2001). Addington rebuffs all attempts to meet with GAO officials, and instead sends a letter refusing to comply with the GAO’s request (see May 16 - 17, 2001). The plan, titled Reliable, Affordable, and Environmentally Sound Energy for America’s Future, warns that the quantity of oil imported per day will need to rise more than fifty percent to 16.7 million barrels by 2020. “A significant disruption in world oil supplies could adversely affect our economy and our ability to promote key foreign and economic policy objectives, regardless of the level of US dependence on oil imports,” the report explains. To meet the US’s rising demand for oil, the plan calls for expanded oil and gas drilling on public land and the easing of regulatory barriers to building nuclear power plants. [US President, 5/16/2001, pp. 8.5 pdf file; Associated Press, 12/9/2002; Guardian, 1/23/2003]
Emphasis on Foreign Oil - The report places substantial emphasis on oil from the Persian Gulf region. Its chapter on “strengthening global alliances” states: “By any estimation, Middle East oil producers will remain central to world oil security. The Gulf will be a primary focus of US international energy policy.” [US President, 5/16/2001, pp. 8.5 pdf file] But it also suggests that the US cannot depend exclusively on traditional sources of supply to provide the growing amount of oil that it needs and will have to obtain substantial supplies from new sources, such as the Caspian states, Russia, Africa, and the Atlantic Basin. Additionally, it notes that the US cannot rely on market forces alone to gain access to these added supplies, but will also require a significant effort on the part of government officials to overcome foreign resistance to the outward reach of American energy companies. Revamping of Clean Air Act - The plan also calls for a clarification of the New Source Review section of the Clean Air Act, which requires energy companies to install state-of-the-art emission control technology whenever it makes major modifications to its plants. The administration’s energy plan gives the Environmental Protection Agency 90 days to review NSR and determine whether it is discouraging companies from constructing or expanding power plants and refineries. It also instructs the attorney general to review current NSR litigation efforts against utility companies to determine whether those efforts are contributing to the country’s energy problems. “The outcome could determine whether the government drops some cases, approaches others more leniently, or even renegotiates settlements already reached,” the New York Times reports. Dodging the EPA - The representative of the Environmental Protection Agency (EPA) on the task force had blocked the recommendation of a technique called “hydraulic fracturing.” Sometimes called “fracking,” the technique, used to extract natural gas from the earth, often contaminates aquifers used for drinking water and irrigation. The recommendation was removed to placate the EPA official, then quietly reinserted into the final draft. Halliburton, Cheney’s former firm, is the US leader in the use of hydraulic fracturing. Cheney Stayed Largely behind the Scenes - Much of the task force’s work was done by a six-member staff, led by executive director Andrew Lundquist, a former aide to senators Ted Stevens (R-AK) and Frank Murkowski (R-AK). Lundquist served as the Bush-Cheney campaign’s energy expert, earning the nickname “Light Bulb” from the president. Lundquist will leave the Bush administration and become a lobbyist for such firms as British Petroleum, Duke Energy, and the American Petroleum Institute. Much of the report is shaped by Lundquist and his colleagues, who in turn relied heavily on energy company executives and their lobbyists. For himself, Cheney did not meet openly with most of the participants, remaining largely behind the scenes. He did meet with Enron executive Kenneth Lay (see April 17, 2001 and After), with officials from Sandia National Laboratories to discuss their economic models of the energy industry, with energy industry consultants, and with selected Congressmen. Cheney also held meetings with oil executives such as British Petroleum’s John Browne that are not listed on the task force’s calendar. [Washington Post, 7/18/2007]
Controversial Meetings with Energy Executives - Both prior to and after the publication of this report, Cheney and other Task Force officials meet with executives from Enron and other energy companies, including one meeting a month and a half before Enron declares bankruptcy in December 2001 (see After January 20, 2001), Mid-February, 2001, March 21, 2001, March 22, 2001, April 12, 2001, and April 17, 2001). Two separate lawsuits are later filed to reveal details of how the government’s energy policy was formed and whether Enron or other players may have influenced it, but the courts will eventually allow the Bush administration to keep the documents secret (see May 10, 2005). In response to a General Accounting Office (GAO) demand for information about the energy task force chaired by Vice President Cheney (see May 8, 2001), Cheney’s chief legal adviser, David Addington, rebuffs the GAO, claiming that the agency has no authority under the Constitution to investigate the task force. The task force is a creature of the executive branch, Addington argues, and as an arm of the legislative branch, the GAO cannot “inquire into the exercise of authorities committed to the executive by the Constitution.” The president can keep any such government deliberations entirely secret from Congress and the public, Addington asserts, in order to guarantee the “candor” of the advice he receives. GAO chief David Walker replies to Addington, rejecting his interpretation of the Constitution. Addington will, in the words of author Charlie Savage, “follow… injury with insult,” responding to Walker’s request for information by conceding that Congress might have the right to know about the direct costs incurred by the task force, and sending 77 pages of mundane expense reports (see June 21, 2001). Vice President Cheney’s top aide, David Addington, begins attending meetings of the Cheney energy task force, further emphasizing the White House’s refusal to cooperate with the General Accounting Office (GAO—see April 19 - May 4, 2001, May 8, 2001, and May 16 - 17, 2001). White House lawyer Bradford Berenson, the legal liaison on the case, is puzzled by the White House’s refusal to cooperate. Most of the information about the task force has already come out in the media, particularly the fact that almost all of the task force’s meetings have been with fossil fuel and nuclear energy corporate executives. But the White House seems willing to weather the controversy in order to keep withholding information from the GAO. In 2007, author Charlie Savage will write, “The long-term payoff was an opportunity to establish a high principle of presidential power: Communications involving the office of the presidency should be secret, whatever a law passed by Congress and signed by some previous president might say.” Addington further enforces the doctrine during the regular morning meetings at the White House counsel’s office, even though he does not work for senior White House counsel Alberto Gonzales. Enron’s power plant in Dabhol, India, is shut down. The failure of the $3 billion plant, Enron’s largest investment, contributes to Enron’s bankruptcy in December. Earlier in the year, India stopped paying its bill for the energy from the plant, because energy from the plant cost three times the usual rates. [New York Times, 3/20/2001] Enron had hoped to feed the plant with cheap Central Asian gas, but this hope was dashed when a gas pipeline through Afghanistan was not completed. The larger part of the plant is still only 90 percent complete when construction stops around this time. [New York Times, 3/20/2001] Enron executives meet with Commerce Secretary Donald L. Evans about its troubled Dabhol power plant during this year [New York Times, 2/21/2002] , and Vice President Cheney lobbies the leader of India’s main opposition party about the plant this month. During this time, President Bush and other top White House officials are given a series of Presidential Daily Briefings relating to an al-Qaeda attack (see January 20-September 10, 2001). The exact contents of these briefings remain classified, but according to the 9/11 Commission they consistently predict upcoming attacks that will occur “on a catastrophic level, indicating that they would cause the world to be in turmoil, consisting of possible multiple—but not necessarily simultaneous—attacks.” CIA Director Tenet later will recall that he feels President Bush and other officials grasp the urgency of what they are being told. [9/11 Commission, 4/13/2004] But Deputy CIA Director John McLaughlin later states that he feels a great tension, peaking these months, between the Bush administration’s apparent misunderstanding of terrorism issues and his sense of great urgency. McLaughlin and others are frustrated when inexperienced Bush officials question the validity of certain intelligence findings. Two CIA officials even consider resigning in protest (see Summer 2001). Cheney is concerned with a situation developing in Oregon, a battleground electoral state that the Bush-Cheney presidential campaign had lost by less than half a percentage point in November 2000. Drought-stricken ranchers and farmers—largely Republican in makeup—are clamoring for the irrigation water they need to keep their croplands and pastures green. [Washington Post, 6/27/2007] The farmers and ranchers of the area are key to the re-election of Senator Gordon Smith (R-OR). [CounterPunch, 7/16/2007] But federal biologists say that the Endangered Species Act gives the government no choice: if the water is released, two imperiled species of fish will be gravely impacted. Both science and the law are on the side of the fish, but Cheney steps in, apparently more out of political concerns for Oregon than for the farmers and ranchers. According to Cheney’s aides, he first looks for a way around the law. According to an Oregon congressman who lobbies for the farmers, when Cheney finds no way to circumvent the law, he instead attacks the science protecting the fish (see April 2002). The government eventually declares, in spite of all scientific evidence, that the water release and subsequent draining of the Klamath River basin will not harm the fish. Instead, the water release causes the largest fish kill in modern Western history (see September 2002). Cheney’s role in the fish kill will not be revealed until 2007. The documents cover little more than mundane expenses by the task force, including a pizza bought by task force chief Andrew Lundquist. The GAO will characterize the documents as “virtually impossible to analyze, as they consisted, for example, of pages with dollar amounts but no indication of the nature or the purpose of the expenditure. A dozen leading politicians, scholars, journalists, and security experts meet at Andrews Air Force Base in Maryland for an exercise simulating the consequences of a biological terrorist attack, in this case the release of smallpox by terrorists. The participants include: Senator Sam Nunn (D-GA), who plays the president of the United States; former presidential adviser David Gergen as the national security advisor; Governor Frank Keating (R-OK), who plays himself; James Woolsey playing the CIA director; and Jerome Hauer as the FEMA director. The exercise, named “Dark Winter,” starts with three states suddenly confronted with an outbreak of smallpox. Americans are no longer vaccinated against this virus because it was eradicated decades ago. Thousands quickly fall ill. The medical system is overwhelmed. Masses start to flee from the infected areas, but are stopped at the borders of neighboring states. Faced with chaos, the exercise ends with the president declaring martial law. Reviewing the exercise, participants and observers agree that the nation is vulnerable to biological terrorism and unprepared for an actual attack. Chris Farrell, the organization’s director of investigations and research, saw a May 2001 Newsweek article about the task force. Farrell later says he was struck by the similarities between Cheney’s energy task force and the 1994 health care task force chaired by then-First Lady Hillary Clinton. “The government can’t operate in secret,” Farrell will later say. “They are answerable to the people. There are appropriate times for secrecy on military and intelligence matters, but the notion that national policy on a matter like energy or health care can be developed in secret is offensive and counter to the Constitution.” Farrell, along with Judicial Watch chairman Larry Klayman and president Thomas Fitton, agreed that the task force violates core conservative principles, and made the decision to challenge Cheney’s office. Their letter notes that the rules governing the task force are clear: if the executive branch chooses to solicit outside advice while writing policy, then the Federal Advisory Committee Act (FACA) is triggered, requiring the government to make the details of those meetings public (the same argument made by the General Accounting Office—see May 8, 2001). “Judicial Watch respectfully requests that, in light of the questionable legal and ethical practices, negative publicity, and public outrage surrounding Hillary Rodham Clinton’s 1994 national health-care policy development group, you direct the [energy task force] to abide by the FACA. CIA Director Tenet makes an urgent special request to 20 friendly foreign intelligence services, asking for the arrests of anyone on a list of known al-Qaeda operatives. [Washington Post, 5/17/2002] Also in late June, the CIA orders all its station chiefs overseas to share information on al-Qaeda with their host governments and to push for immediate disruptions of al-Qaeda cells. Vice President Cheney asks Saudi Crown Prince Abdullah for help on July 5, and counterterrorism “tsar” Richard Clarke makes appeals to other foreign officials. As a result, several terrorist operatives are detained by foreign governments. According to a later analysis by the 9/11 Commission, this possibly disrupts operations in the Persian Gulf and Italy (see June 13, 2001) and perhaps averts attacks against two or three US embassies. For instance, al-Qaeda operative Djamel Beghal is detained by the French government in July and gives up information about a plot to attack the US embassy in France (see July 24 or 28, 2001). ABC reporter Ted Koppel asks Vice President Dick Cheney about meetings with his “pals” from the oil and energy industries (see January 29, 2001 and April 17, 2001 and After). Koppel is referring to the attempts by Congress to be given the names of the participants in Cheney’s energy task force meetings. Cheney says: “I think it’s going to have to be resolved in court, and I think that’s probably appropriate. I think, in fact, that this is the first time the GAO [Government Accountability Office] has ever issued a so-called demand letter to a president/vice president. I’m a duly elected constitutional officer. The idea that any member of Congress can demand from me a list of everybody I meet with and what they say strikes me as—as inappropriate, and not in keeping with the Constitution.” Authors Lou Dubose and Jake Bernstein will later write, “The vice president was deftly turning a request for records into a constitutional struggle between the legislative and executive branches.” Representative Henry Waxman (D-CA), who issued the original requests before turning them over to the GAO, will put his demands for information on hold because of the 9/11 attacks and the war in Afghanistan, but the case will indeed end up in court (see February 22, 2002). While it is billed a “working vacation,” news organizations report that Bush is doing “nothing much” aside from his regular daily intelligence briefings. [ABC News, 8/3/2001; Washington Post, 8/7/2001; Salon, 8/29/2001] One such unusually long briefing at the start of his trip is a warning that bin Laden is planning to attack in the US (see August 6, 2001), but Bush spends the rest of that day fishing. By the end of his trip, Bush has spent 42 percent of his presidency at vacation spots or en route. Hebert announced his resignation on August 6. [US Department of Energy, 12/2001] Hebert, a Clinton appointee who nevertheless is a conservative Republican, an ally of Senator Trent Lott (R-MS), and quite friendly towards the energy corporations, had been named to the FERC shortly before Clinton left office; Bush named him to chair the commission in January 2001. Replaced at Enron Request - Hebert is apparently replaced at the request of Enron CEO Kenneth Lay, who did not find Hebert responsive enough in doing Enron’s bidding. Hebert had just taken the position of FERC chairman in January when he received a phone call from Lay, in which Lay pressured him to back a faster pace in opening up access to the US electricity transmission grid to Enron and other corporations. (Lay later admits making the call, but will say that keeping or firing Hebert is the president’s decision, not his.) When Hebert did not move fast enough for Lay, he is replaced by Pat Wood, a close friend of both Lay and President Bush. [Guardian, 5/26/2001; Los Angeles Times, 12/11/2001] Lay apparently threatened Hebert with the loss of his job if he didn’t cooperate with Enron’s request for a more pro-Enron regulatory posture. Opposed Enron Consolidation Plan - Hebert was leery of Enron’s plan to force consolidation of the various state utilities into four huge regional transmission organizations (RTOs), a plan that would have given Enron and other energy traders far larger markets for their energy sales. Hebert, true to his conservative beliefs, is a states’ rights advocate who was uncomfortable with the plan to merge the state utilities into four federal entities. Lay told Hebert flatly that if he supported the transition to the RTOs, Lay would back him in retaining his position with FERC. Hebert told reporters that he was “offended” at the veiled threat, but knew that Lay could back up his pressure, having already demonstrated his influence over selecting Bush administration appointees by giving Bush officials a list of preferred candidates and personally interviewing at least one potential FERC nominee (see January 21, 2001). [PBS, 2/2/2002; Consortium News, 5/26/2006] According to Hebert, Lay told him that “he and Enron would like to support me as chairman, but we would have to agree on principles.” [Guardian, 5/26/2001] Hebert added to another reporter, “I think he would be a much bigger supporter of mine if I was willing to do what he wanted me to do.” Lay recently admitted to making such a list of preferred candidates: “I brought a list. We certainly presented a list, and I think that was by way of letter. As I recall I signed a letter which, in fact, had some recommendations as to people that we thought would be good commissioners.…I’m not sure I ever personally interviewed any of them but I think in fact there were conversations between at least some of them and some of my people from time to time.” [PBS, 2/2/2002]
Cheney Behind Ouster - Joe Garcia, a Florida energy regulator, says he was interviewed by Lay and other Enron officials. After Hebert made it clear to Lay that he wouldn’t go along with Lay’s plans to reorganize the nation’s utilities, Vice President Dick Cheney, who supervises the Bush administration’s energy policies (see May 16, 2001, began questioning Hebert’s fitness. [Guardian, 5/26/2001] Cheney said in May 2001, “Pat Wood has got to be the new chairman of FERC.” In private, Cheney said then that Hebert was out as chairman and Wood was in, though Hebert did not know at the time that his days were numbered. [PBS, 2/2/2002] “It just confirms what we believed and what we’ve been saying, that the Bush-Cheney energy plan is written by corporations and it’s in the interests of the corporations,” says the National Environmental Trust’s Kevin Curtis. [Guardian, 5/26/2001] Not only was Hebert not responsive enough to Lay’s pressure, but he had become a focus of criticism for his refusal to scrutinize Enron’s price gouging in the California energy deregulation debacle. Wood’s more moderate position helps ease the worries of other states themselves losing confidence in the Bush administration’s deregulation advocacy. [American Prospect, 1/2/2002]
Hebert Investigating Enron Schemes - And even more unsettling for Enron, Hebert was beginning to investigate Enron’s complicated derivative-financing procedures, an investigation that may have led to an untimely exposure of Enron’s financial exploitation of the US’s energy deregulation—exploitation that was going on under plans nicknamed, among other monikers, “Fat Boy,” “Death Star,” “Get Shorty,” all of which siphoned electricity away from areas that needed it most and being paid exorbitant fees for phantom transfers of energy supposedly to ease transmission-line congestion. [Consortium News, 5/26/2006] “One of our problems is that we do not have the expertise to truly unravel the complex arbitrage activities of a company like Enron,” Hebert recently told reporters. “We’re trying to do it now and we may have some results soon.” [Guardian, 5/26/2001] Instead, Hebert is forced out of FERC. Senator Dianne Feinstein (D-CA) called for an investigation into Enron’s improper influence of the FERC committee after the media revealed Lay’s phone call to Hebert in May 2001 (see May 25, 2001).

The General Accounting Office (GAO)‘s chief, Comptroller General David Walker, issues a report detailing the history of the GAO’s request for information regarding Vice President Cheney’s secret energy task force, and reiterating its request (see July 31, 2001). The report is sent to President Bush, Cheney, Congress, the attorney general, and the Office of Management and Budget (OMB). It reads in part: “In communications with the vice president’s counsel… we offered to eliminate our earlier request for minutes and notes and for the information presented by members of the public. Even though we are legally entitled to this information, as a matter of comity, we are scaling back the records we are requesting to exclude these two items of information.… The GAO as an institution, and the comptroller general as an officer of the legislative branch, assist the Congress in exercising its responsibilities under the Constitution to oversee, investigate, and legislate. In order to help members of Congress carry out their role and evaluate the process used to develop the National Energy Policy, GAO needs selected factual and non-deliberative records that the vice president, as chair of the NEPDG [National Energy Policy Development Group, the formal name for Cheney’s task force], or others representing the Group, are in a position to provide GAO. The Bush administration blocks the Environmental Protection Agency (EPA) from making any announcement about vermiculite and related problems in towns where it was mined. Vermiculite is dangerous because one of the substances it contains, tremolite, itself contains lethal levels of asbestos fiber and has killed or seriously sickened thousands of inhabitants of Libby, Montana, one of the towns where it was mined. EPA chief Christine Todd Whitman visits Libby at this time, although the vermiculite mine there was shut down in 1990. However, the problem is not confined to Libby; according to EPA records, over 16 billion tons of vermiculite have been shipped to 750 fertilizer and insulation manufacturers throughout the US, and the EPA estimates that between 15 million and 35 million US homes have been insulated with this toxic material. The EPA is thus confronted with an enormously grave problem. After the St. Louis Post-Dispatch breaks the story in late 2002 based on a leak from an unnamed whistleblower, former EPA chief William Ruckelshaus calls the actions of the White House “wrong, unconscionable.” The story becomes even more important when the reason for the White House block becomes known. Vice President Dick Cheney, the former CEO of Halliburton, is pressuring Congress to pass legislation that would absolve companies of any legal liability for claims arising from asbestos exposure. Halliburton itself is facing a tremendous number of asbestos liability claims. [Dean, 2004, pp. 162-163]

Dan Burton (R-IN), the chairman of the House Government Reform Committee, asks for more than twelve sets of internal Justice Department documents that detail purported fund-raising abuses by the 1996 presidential campaign of Bill Clinton and Al Gore. Burton also wants documents relating to the FBI’s use of mob informants by its Boston office, where evidence indicates that the office literally let the informants get away with murder and suppressed evidence that allowed an innocent man to go to prison. Burton’s request causes a dilemma for the White House. On the one hand, President Bush and Vice President Cheney have given explicit instructions for staffers to resist such calls for information. On the other hand, when Burton had delved into the questions surrounding Clinton’s last-minute pardons, Bush had already given him unprecedented access to Clinton’s private conversations (see August 21, 2001). Burton immediately released edited transcripts of the tapes (see August 21, 2001). The administration ponders whether or not to release the documents, and in the process perhaps further impugn Clinton, or to refuse, preserving their standard of executive privilege. Time magazine writes an article calling Secretary of State Colin Powell the “odd man out” in the administration, adding that his centrist politics make Powell “chum in the water for the sharks in Dubya’s sea,” particularly Vice President Cheney and Defense Secretary Donald Rumsfeld. One top diplomat, asked to provide an adjective for the phrase, “Colin Powell is a ‘blank’ secretary of state,” replies, “Yes, he is.” A senior administration official says, “I’ve been struck by how not struck I am by him.” Time itself writes, “Powell’s megastar wattage looks curiously dimmed, as if someone has turned his light way down.” When Deputy Defense Secretary Paul Wolfowitz is asked why he took the number two spot in the Pentagon, he replies with one word: “Powell” (see January 11, 2001). (Wolfowitz will later deny making the remark.) Author Craig Unger will later write that Wolfowitz’s terse reply “gave the game away. He was there to neutralize Powell, to implement the hard-line neocon[servative] vision.” The Time article concludes, “Enthusiasm is building inside the administration to take down [Iraq’s] Saddam [Hussein] once and for all,” a policy to which Powell is opposed. President Bush’s cabinet-rank advisers discuss terrorism for the second of only two times before 9/11. [Washington Post, 5/17/2002] National Security Adviser Rice chairs the meeting; neither President Bush nor Vice President Cheney attends. Counterterrorism “tsar” Richard Clarke later says that in this meeting, he and CIA Director Tenet speak passionately about the al-Qaeda threat. No one disagrees that the threat is serious. Secretary of State Powell outlines a plan to put pressure on Pakistan to stop supporting al-Qaeda. Defense Secretary Rumsfeld appears to be more interested in Iraq. The only debate is over whether to fly the armed Predator drone over Afghanistan to attack al-Qaeda (see September 4, 2001). [Clarke, 2004, pp. 237-38] Clarke’s earlier plans to “roll back” al-Qaeda first submitted on January 25, 2001 (see January 25, 2001) have been discussed and honed in many meetings and are now presented as a formal National Security Presidential Directive. The directive is “apparently” approved, though the process of turning it into official policy is still not done. [9/11 Commission, 3/24/2004] There is later disagreement over just how different the directive presented is from Clarke’s earlier plans. For instance, some claim the directive aims not just to “roll back” al-Qaeda, but also to “eliminate” it altogether. [Time, 8/12/2002] However, Clarke notes that even though he wanted to use the word “eliminate,” the approved directive merely aims to “significantly erode” al-Qaeda. The word “eliminate” is only added after 9/11. [Washington Post, 3/25/2004] Clarke will later say that the plan adopted “on Sept. 4 is basically… what I proposed on Jan. 25. And so the time in between was wasted.” [ABC News, 4/8/2004] The Washington Post will similarly note that the directive approved on this day “did not differ substantially from Clinton’s policy.” [Washington Post, 3/27/2004] Time magazine later comments, “The fight against terrorism was one of the casualties of the transition, as Washington spent eight months going over and over a document whose outline had long been clear.” [Time, 8/12/2002] The primary change from Clarke’s original draft is that the approved plan calls for more direct financial and logistical support to the Northern Alliance and other anti-Taliban groups. The plan also calls for drafting plans for possible US military involvement, “but those differences were largely theoretical; administration officials told the [9/11 Commission’s] investigators that the plan’s overall timeline was at least three years, and it did not include firm deadlines, military plans, or significant funding at the time of the September 11, 2001, attacks.” [Washington Post, 3/27/2004; Reuters, 4/2/2004]

According to journalist and author Stephen Hayes, Cheney’s colleagues have learned to keep any impromptu sessions with him short and succinct. Yet O’Keefe spends more than 20 minutes with the vice president. Cheney is scheduled to meet John McConnell, his chief speechwriter, at 8:30 a.m. Yet McConnell is left waiting outside the office while the vice president is deep in discussion with O’Keefe. According to Hayes, while the topic of O’Keefe and Cheney’s conversation seems urgent at present, “In time, neither man would be able to recall what it was that had been so important.” [Hayes, 2007, pp. 328-330] O’Keefe is a former Pentagon comptroller, and had been a close confidant of Dick Cheney’s when he was the secretary of defense, in the early 1990s. Vice President Dick Cheney later claims he learns of the first attack on the World Trade Center just before 9:00 a.m. He has just finished an impromptu discussion in his office at the White House with Sean O’Keefe, the deputy director of the Office of Management and Budget (see (8:25 a.m.-8:50 a.m.) September 11, 2001). His chief speechwriter John McConnell has come in for a meeting, when his secretary, Debbie Heiden, calls in and tells him a plane hit the WTC. Cheney recalls, “So we turned on the television and watched for a few minutes.” However, journalist and author Stephen Hayes suggests Cheney learns of the attack earlier. He says that while McConnell is waiting for his meeting, O’Keefe comes out of the vice president’s office. McConnell gestures at a television showing the burning WTC, and “O’Keefe nodded; they had been watching the reports inside.” When McConnell enters Cheney’s office, “The small television on the other side of the desk was tuned to ABC News.” [Meet the Press, 9/16/2001; Hayes, 2007, pp. 328-330] According to his own recollection, Cheney is puzzled by the reports: “I was sitting there thinking about it. [Source: Congressional Pictorial Directory]Speaker of the House Dennis Hastert, who is third in line for the presidency, is in his office suite on the second floor of the US Capitol building when he sees the second plane hitting the World Trade Center live on television. [Hastert, 2004, pp. 5] He is told that Vice President Dick Cheney will soon be calling him on the secure telephone in his office. [Daily Herald (Arlington Heights), 9/11/2002] However, Cheney is currently having problems using secure phones, and Hastert is too. Hastert later recalls, “To use the secure phone, you have to push a button and turn a key. On that dreadful day I couldn’t make the thing work. No matter what I did, I couldn’t connect with the vice president. As the minutes passed, my frustrations grew.” [Hastert, 2004, pp. 6; Hayes, 2007, pp. 336] Several attempts to reach the vice president are unsuccessful. Hastert’s later explanation is that “Anyone who has used a secure phone can tell you they do not work very well.” However, numerous other people in the Washington area, including senior government officials, are also experiencing serious communications problems throughout the day (see (After 8:55 a.m.) September 11, 2001). Around the time the Pentagon is hit, the light on Hastert’s regular phone starts flashing, but instead of being Cheney it is apparently a nuisance caller, who complains, “I can’t get a hold of Jeb Bush, I can’t get a hold of the president, I can’t get a hold of Colin Powell. All this stuff is happening. What are you guys doing?” When Hastert asks the caller who they are, their reply is, “I’m just a citizen. Who is this?” [Chicago Sun-Times, 9/25/2001; Daily Herald (Arlington Heights), 9/11/2002; Associated Press, 6/16/2007] Shortly afterwards, the Capitol is evacuated (see 9:48 a.m. September 11, 2001) and Hastert’s Secret Service agents hurry him out of the building. Vice President Dick Cheney sees the second plane hitting the World Trade Center live on television while meeting with his speechwriter John McConnell. Nelson Garabito.Nelson Garabito. [Source: CNN]A senior Secret Service agent at the White House establishes a direct phone line with his counterpart at the FAA and is told there are more suspect planes that are unaccounted for, but this information supposedly does not lead to the evacuation of the vice president from his White House office.
Secret Service Liaison Calls FAA - Secret Service agent Nelson Garabito, who is responsible for coordinating the president’s movements and is also the agency’s liaison to the FAA, is at the Secret Service Joint Operations Center (JOC) at the White House, attending a 9:00 a.m. meeting. After seeing the second attack on the World Trade Center on television, he calls Terry Van Steenbergen, his counterpart at the FAA. According to Garabito, the TV’s sound is off, so it takes a few minutes before he realizes a second plane has hit the WTC and makes the call. But Van Steenbergen, who is at FAA headquarters in Washington, DC, will say Garabito calls him “within 30 seconds” of the attack.
Warning Not Passed On - Shortly into the call, Van Steenbergen tells Garabito there are two unaccounted for planes that are possibly hijacked, in addition to the two that have crashed into the WTC. Garabito tells someone with him to run upstairs and pass this information on to other Secret Service agents, but, according to the 9/11 Commission, “it either was not passed on or was passed on but not disseminated.” As a result, Van Steenbergen’s information “failed to reach agents assigned to the vice president, and the vice president was not evacuated at that time.” [9/11 Commission, 7/28/2003, pp. 9-11; 9/11 Commission, 3/30/2004; 9/11 Commission, 7/24/2004, pp. 464]
Conflicting Evacuation Times - According to the 9/11 Commission, the Secret Service does not evacuate Vice President Dick Cheney from his office at the White House until “just before 9:36.” [9/11 Commission, 7/24/2004, pp. 39] However, some accounts will say Cheney is evacuated around the time of the second attack on the WTC (see (Shortly After 9:03 a.m.) September 11, 2001), which would suggest that Van Steenbergen’s information is indeed passed on and disseminated. [New York Times, 9/13/2001; ABC News, 9/14/2002] Garabito and Van Steenbergen will remain in contact over the phone—via a direct line, not a conference call—for the next 14 hours. White House adviser Karl Rove, who is with the president in Florida, will tell NBC News that when Bush tries phoning Cheney at around 9:16 a.m., he is unable to contact him because “the vice president was being… grabbed by a Secret Service agent and moved to the bunker” (see (9:16 a.m.-9:29 a.m.) September 11, 2001). [MSNBC, 9/11/2002] And Transportation Secretary Norman Mineta will say that when he arrives at the PEOC, between around 9:20 a.m. and 9:27 a.m., Cheney is already there (see (Between 9:20 a.m. and 9:27 a.m.) September 11, 2001). Counterterrorism “tsar” Richard Clarke is driving up to a gate outside the White House when Lisa Gordon-Hagerty—a member of his staff who is already at the White House—calls and tells him, “The other tower was just hit.” He responds: “Well, now we know who we’re dealing with. I want the highest level person in Washington from each agency on-screen now, especially the FAA.” He ordered Gordon-Hagerty to set up a secure video conference about five minutes earlier. A few minutes later, according to his own recollections, Clarke finds Vice President Dick Cheney and National Security Adviser Condoleezza Rice in Cheney’s White House office. Clarke tells Cheney: “It’s an al-Qaeda attack and they like simultaneous attacks. This may not be over.” Rice asks Clarke for recommendations, and he says, “We’re putting together a secure teleconference to manage the crisis.” He also recommends evacuating the White House. (A slow evacuation of the White House will begin around 9:20-9:25 (see (9:20 a.m.) September 11, 2001).) Rice notes the Secret Service wants them to go to the Presidential Emergency Operations Center (PEOC) below the White House, and as Clarke leaves the other two, he sees Cheney gathering up his papers. He instructs his press secretary, Ari Fleischer, to take notes to create an accurate accounting of events. According to some accounts, he speaks on the phone with Vice President Dick Cheney who is at the White House, and they both agree that terrorists are probably behind the attacks. [Sammon, 2002, pp. 92-93; Daily Mail, 9/8/2002; 9/11 Commission, 7/24/2004, pp. 39] But White House adviser Karl Rove, who is also in the holding room, will later tell NBC News that Bush is unable to reach Cheney because the vice president is being moved from his office to the White House bunker at this time. Bush learns from Mueller that the planes that hit the WTC were commercial American aircraft, and at least one of them had apparently been hijacked after leaving Boston. According to some accounts, Bush also speaks with National Security Adviser Condoleezza Rice around this time. However, Rice herself will later suggest otherwise (see (9:45 a.m.) September 11, 2001). Bush will deliver this at 9:30 a.m. (see 9:30 a.m. September 11, 2001). While he works on the statement, Bush briefly glances at the unfolding horror on the television. Turning to his aides in the room, he declares, “We’re at war.” [Sammon, 2002, pp. 94; Albuquerque Tribune, 9/10/2002] According to the 9/11 Commission, the focus at the present time is on the president’s statement to the nation, and the only decision made by Bush’s traveling party is to return to Washington. Yet, while admitting there is “conflicting evidence about when the vice president arrived” in the PEOC, the 9/11 Commission will conclude that the “vice president arrived in the room shortly before 10:00, perhaps at 9:58.” Mineta also later claims that when he arrives in the PEOC, Mrs. Lynne Cheney, the wife of the vice president, is already there. Yet the 9/11 Commission will claim she only arrives at the White House at 9:52 (see (9:55 a.m.) September 11, 2001). Managers from American Airlines and United Airlines are added by the FAA to a teleconference, but they receive no guidance from top government officials on what to do. According to author Lynn Spencer, at some point after the second aircraft hit the World Trade Center, the executives from the two airlines are “quickly on the phone to FAA headquarters and the FAA Command Center.” They are brought into “a conference call that has now been set up with Secretary of Transportation Norman Mineta and Vice President Dick Cheney at the White House. The airline executives inform the secretary that they are each dealing with additional aircraft that they are unable to contact. They seek guidance, but there is none.… The nation is under attack, but there is no plan in place, and no guidance is forthcoming from the top as the crisis escalates.” [Spencer, 2008, pp. 109] The time when the airline executives join the teleconference is unclear. In Spencer’s account, she places it after United Airlines dispatchers have warned their aircraft to secure their cockpits (see (Shortly After 9:21 a.m.) September 11, 2001), which would mean some time after 9:21. [9/11 Commission, 8/26/2004, pp. 37 pdf file; Spencer, 2008, pp. 109] But Spencer also says that, when the executives join the conference, the “president is still reading to children in a Florida school room” (see (9:06 a.m.-9:16 a.m.) September 11, 2001), which would be roughly between 9:05 and 9:15. [9/11 Commission, 7/24/2004, pp. 38-39; Spencer, 2008, pp. 109] If Norman Mineta is already participating in the teleconference when the airline executives join it, the time would have to be after around 9:20, which is when Mineta later says he arrived at the Presidential Emergency Operations Center (PEOC) below the White House (see (Between 9:20 a.m. and 9:27 a.m.) September 11, 2001). [9/11 Commission, 5/23/2003] And Cheney, who Spencer also says is participating in the teleconference when the executives join it, arrives at the PEOC as late as 9:58, according to the 9/11 Commission, although other accounts indicate he arrives there much earlier than this (see (Shortly After 9:03 a.m.) September 11, 2001). [ABC News, 9/14/2002; 9/11 Commission, 7/24/2004, pp. 40] According to the Wall Street Journal, American Airlines president Don Carty and United Airlines CEO Jim Goodwin are talking on the phone with Mineta (presumably over the conference call) about five minutes before the FAA shuts down all US airspace (see (9:45 a.m.) September 11, 2001), which would mean they are participating in the teleconference by around 9:40 a.m. [US Congress. According to some accounts, Vice President Dick Cheney is in the Presidential Emergency Operations Center (PEOC) below the White House by this time, along with Transportation Secretary Norman Mineta and others. Mineta will recall that, while a suspicious plane is heading toward Washington, an unidentified young man comes in and says to Cheney, “The plane is 50 miles out.” Mineta confers with acting FAA Deputy Administrator Monte Belger, who is at the FAA’s Washington headquarters. Belger says to him: “We’re watching this target on the radar, but the transponder’s been turned off. So we have no identification.” According to Mineta, the young man continues updating the vice president, saying, “The plane is 30 miles out,” and when he gets down to “The plane is 10 miles out,” asks, “Do the orders still stand?” In response, Cheney “whipped his neck around and said, ‘Of course the orders still stand. Have you heard anything to the contrary?’” Mineta will say that, “just by the nature of all the events going on,” he infers that the order being referred to is a shootdown order. Nevertheless, Flight 77 continues on and hits the Pentagon. [BBC, 9/1/2002; ABC News, 9/11/2002; 9/11 Commission, 5/23/2003; 9/11 Commission, 5/23/2003; St. Petersburg Times, 7/4/2004] However, the 9/11 Commission will later claim the plane heading toward Washington is only discovered by the Dulles Airport air traffic control tower at 9:32 a.m. (see 9:32 a.m. September 11, 2001). But earlier accounts, including statements made by the FAA and NORAD, will claim that the FAA notified the military about the suspected hijacking of Flight 77 at 9:24 a.m., if not before (see (9:24 a.m.) September 11, 2001). The FBI’s Washington Field Office was also reportedly notified that Flight 77 had been hijacked at about 9:20 a.m. (see (9:20 a.m.) September 11, 2001). The 9/11 Commission will further contradict Mineta’s account saying that, despite the “conflicting evidence as to when the vice president arrived in the shelter conference room [i.e., the PEOC],” it has concluded that he only arrived there at 9:58 a.m. [9/11 Commission, 6/17/2004] According to the Washington Post, the discussion between Cheney and the young aide over whether “the orders” still stand occurs later than claimed by Mineta, and is in response to Flight 93 heading toward Washington, not Flight 77. A supervisor at Washington’s Reagan National Airport calls the Secret Service Joint Operations Center (JOC) and warns it about an unidentified aircraft that is heading toward the White House. [Federal Aviation Administration, 9/14/2001; Federal Aviation Administration, 9/17/2001 pdf file; 9/11 Commission, 7/24/2004, pp. 9] Controllers at Reagan Airport have just been contacted by controllers at Washington Dulles International Airport, and notified of the unidentified aircraft, later determined to be Flight 77, approaching Washington (see (9:33 a.m.) September 11, 2001). [Washington Post, 9/11/2001; 9/11 Commission, 8/26/2004, pp. 33 pdf file]
Supervisor Calls Secret Service - Immediately after he learns of this aircraft, Victor Padgett, the operations supervisor at the Terminal Radar Approach Control (TRACON) at Reagan Airport, picks up a direct line to the White House and informs the Secret Service JOC there: “We have a target five [miles] west. He’s turning south but he’s still on our scope. We’re not talking to him. It’s definitely a suspicious aircraft.” [Federal Aviation Administration, 9/14/2001; Spencer, 2008, pp. 146] According to the 9/11 Commission, this is “the first specific report to the Secret Service of a direct threat to the White House.” [9/11 Commission, 7/24/2004, pp. 39] Padgett provides the Secret Service with continuous updates on the aircraft’s actions. [Federal Aviation Administration, 9/14/2001; Federal Aviation Administration, 9/17/2001 pdf file] After traveling almost 10 miles south of Reagan Airport, the aircraft turns back toward Washington and again appears to be heading for the White House. Padgett tells the Secret Service: “What I’m telling you, buddy, if you’ve got people, you’d better get them out of there! And I mean right g_ddamned now![Spencer, 2008, pp. 158] (People will begin rapidly evacuating from the White House at about 9:45 a.m. (see (9:45 a.m.) September 11, 2001). Cheney Not Evacuated - According to the 9/11 Commission, when Padgett initially calls the JOC, “No move [is] made to evacuate the vice president” from his White House office. The officer who takes the call will explain, “[I was] about to push the alert button when the tower advised that the aircraft was turning south and approaching Reagan National Airport.” According to the Commission, Vice President Dick Cheney is not evacuated until “just before 9:36” (see (9:35 a.m.) September 11, 2001 and (9:36 a.m.) September 11, 2001). [9/11 Commission, 7/24/2004, pp. 39] (However, other accounts indicate he was evacuated earlier on, shortly after 9:00 a.m. (see (Shortly After 9:03 a.m.) September 11, 2001). A number of witnesses see a helicopter flying near the Pentagon in the minutes before the attack there.
bullet Jeffrey Mark Parsons, an assistant chief patrol agent with the United States Border Patrol, sees a blue and white helicopter that appears as if it is coming in to land, from a window on the 17th floor of the hotel he is staying at, near the Pentagon. Parsons will later recall that two or three minutes before the Pentagon attack occurs: “I saw [the helicopter] circle… between the hotel and the Pentagon, going toward the landing pad [at the Pentagon] where that airliner ultimately hit. And I thought that he landed on the pad.” Parsons will say the helicopter flies in at “a weird angle,” and recall that he has been staying at the Marriott Residence Inn in Arlington for almost a month, but has “never seen a helicopter approach the Pentagon from that direction before.” He will recognize the helicopter as a Huey because he has flown Hueys and knows they make “a very distinct sound.” According to John Darrell Sherwood, a Navy historian who interviews Parsons about the incident, the helicopter belongs to the US Park Police and has been instructed to intercept the aircraft that subsequently hits the Pentagon (see Shortly Before 9:35 a.m. September 11, 2001). bullet A senior Air Force officer who is somewhere outside the Pentagon also sees a helicopter circling the Pentagon around this time, although he believes it to be a US military helicopter. Shortly after the Pentagon attack, the unnamed officer will tell a CNN reporter that the helicopter “disappeared behind the building where the helicopter landing zone is… and he then saw [a] fireball go into the sky” when the Pentagon is hit. [CNN, 9/11/2001]
bullet Jennifer Reichert, who is stuck in traffic on Route 27 in front of the Pentagon, will later describe that just before the attack, “A helicopter takes off from the heliport at the Pentagon.” She will add: “Minutes—maybe seconds—later, I hear it: American Airlines Flight 77 screams toward the Pentagon. The explosion [of the crash] shakes my car.” [Washington Post, 9/5/2002]
Perhaps due to the presence of this helicopter in the area, some people will initially think the attack on the Pentagon involves a helicopter hitting the building. Captain William Durm, the commander of the Pentagon’s Triservice Dental Clinic, will head to the building’s center courtyard shortly after the Pentagon is hit. Someone there will tell him a helicopter has hit the other side of the building. [Office of Medical History, 9/2004, pp. 11] Some early news reports will suggest a helicopter crashed into the Pentagon. [Poynter Institute, 9/11/2001; Thomas Crosbie Media, 9/11/2001] One report will claim that “one aircraft and a helicopter have crashed into the Pentagon.” [Airline Industry Information, 9/11/2001] Vice President Dick Cheney will later tell NBC’s Meet the Press that “the first reports on the Pentagon attack suggested a helicopter” hit the building. [Meet the Press, 9/16/2001] The Guardian will report that one witness claims the explosion that occurs when the Pentagon is hit blows up a helicopter circling overhead. [Guardian, 9/12/2001] New York Times columnist William Safire will report that, at approximately this time, Cheney is told that either another plane or “a helicopter loaded with explosives” is heading for the White House. [New York Times, 9/13/2001]
