Congressional Democrats are highly critical of President Bush’s proposal to abandon the 1972 Anti-Ballistic Missile Treaty and instead implement a “new strategic framework” for the US’s defense against nuclear weapons (see May 1, 2001). Senate Majority Leader Tom Daschle (D-SD) says: “Many in the administration… argue that deploying an ineffective defense can still be an effective system simply because it would cause uncertainty in the minds of our adversaries. That position is based on the flawed assumption that a president would be willing to gamble our nation’s security on a bluff, and that no adversary would be willing or able to call such a bluff. Instead of increasing our security, pursuing a strategy that cannot achieve its goal could leave our nation less secure and our world less stable.” Senator Joseph Biden (D-DE), an acknowledged expert on US defense capabilities, says, “To abandon the ABM with the hope to get that [missile defense] capacity somewhere down the line would damage the security interests of the United States.” Senator John Kerry (D-MA) notes: “If you can’t shoot down 100 percent of them [nuclear missiles], you haven’t gotten rid of mutually assured destruction. [Source: John Glenn Archives, Ohio State University]Despite being a potential target for terrorists, the US Capitol building in Washington is not evacuated when the second World Trade Center tower is hit and it is clear the US is under attack. [CNN, 9/11/2002] Senate Majority Leader Tom Daschle (D) is in the lobby of his office at the Capitol, and some of his staff members there are watching the television coverage of events in New York. Daschle has already been told about the first plane hitting the WTC, and then sees the second one hitting the South Tower live on television. As Daschle later recalls, he now realizes, “This is an attack.” Former Senator John Glenn (D), who has stopped by to say hello to Daschle, now warns him: “I’m not sure you ought to be here. This would be a logical target.” Indeed, Daschle will later comment, “I’ve heard people observe since that day what a prime target the Capitol building makes for such an air attack—this brilliant white structure perched on its own terraced hill, its dome outlined against the sky, with the broad, sprawling expanse of the Mall leading up to it like a long open runway.” [Daschle and D'Orso, 2003, pp. 105-107; Kent State University, 5/10/2004] A bestselling 1994 novel by Tom Clancy in fact included the plotline of a suicide pilot deliberately crashing a Boeing 747 into the Capitol building (see August 17, 1994). [New York Times, 10/2/1994; Newsday, 5/20/2002] Yet Daschle is able to continue with his scheduled weekly team meeting with his senior staff, where they discuss budget issues. [Daschle and D'Orso, 2003, pp. 106-107] Even by the time the Pentagon is hit, more than 25 minutes later, there will still have been no evacuation of the Capitol. [CNN, 9/11/2002] The building will eventually be evacuated around 9:48 a.m., reportedly due to fears of a plane approaching it (see 9:48 a.m. September 11, 2001). Reports of Plane Approaching the Capitol - The evacuation appears to be in response to reports of a plane heading toward the Capitol. [Associated Press, 9/11/2001; CNN, 8/17/2002; Bamford, 2004, pp. 80-81] According to CNN congressional correspondent Dana Bash, “the Capitol Police were hearing, in their radio, that there was a plane—another plane in the air, likely headed for the Capitol.” [CNN, 9/11/2006] When a Capitol Police officer instructs Senate Majority Leader Tom Daschle (D) to leave the building, he says: “We have word that an airplane is heading this way and could hit the building anytime. You need to evacuate.”
'Nothing Orderly' about Evacuation - However, there are problems with the evacuation. According to Daschle, “The fire alarm system, which was working in the nearby Senate office buildings, was never activated in the Capitol, so there were people who weren’t aware that an evacuation was taking place.” Also, some individuals are reluctant to leave. [Daschle and D'Orso, 2003, pp. 109-110] Rep. Bob Stump (R) will recall: “They tried to throw me out three times, but they didn’t succeed. I figured I was safer in the building than out on the street.” [Associated Press, 9/11/2001] Daschle will recall that there is “nothing orderly” about the evacuation. Outside the building “No one knew what to do or where to go. People congregated on the grass and in the parking lot. Senators and staff were mixed in with tourists, all staring up at the sky, wondering what might be headed our way.” [Daschle and D'Orso, 2003, pp. 110] CNN will report, “[S]ome of the most high ranking officials in the United States government were just kind of scattered around this area without a gathering point.” [CNN, 9/11/2006]
Sergeant at Arms Concerned over Poor Security - Al Lenhardt, the Senate’s sergeant at arms, will later say how alarmed he was “to see members of Congress and their staffs mixed in with visitors and passersby wandering in the open around the Capitol grounds. One of the tactics that terrorists have been known to employ is to create a diversion to move their intended target to the area where the actual attack will take place. Al imagined a bomb or gunfire erupting right there on the lawn outside the Capitol.” [Daschle and D'Orso, 2003, pp. 111] Eventually, many of the members of Congress go to the Capitol Police headquarters, which then serves as their command center for the day (see (9:55 a.m. and After) September 11, 2001 and (10:00 a.m.-6:30 p.m.) September 11, 2001). [Source: CNN]After the Capitol building in Washington is evacuated (see 9:48 a.m. September 11, 2001), those located around it—including members of Congress—experience serious problems communicating by phone and other means. CNN senior political correspondent Candy Crowley will describe: “Nobody knew anything.… Nobody had any way to communicate.… The cell phones went down. Eventually… the personal BlackBerrys that bring your e-mail to you, they went down. And inside the Capitol, remember [there are] still switchboard operators there. Inside the Capitol, the phones worked only on and off.” According to Senator Edward Kennedy (D), there is “no communication whatsoever going on.” [CNN, 9/11/2002] Senate Majority Leader Tom Daschle (D) will recall: “People were punching their cell phones to no avail. The lines were jammed.” [Daschle and D'Orso, 2003, pp. 110] Consequently, for more than an hour Daschle’s own staff is unable to establish where he is. [Washington Post, 1/27/2002] House Speaker Dennis Hastert (R) was experiencing communications problems even before he was evacuated from the Capitol, while trying to contact Vice President Dick Cheney by phone (see (9:04 a.m.-9:45 a.m.) September 11, 2001). [Hastert, 2004, pp. 6; Hayes, 2007, pp. 336] Whether others at the Capitol also experienced similar difficulties prior to the evacuation is unclear. What causes these problems is uncertain. However, numerous other people in the Washington area, including senior government officials, also experience serious communications problems throughout the day (see (After 8:55 a.m.) September 11, 2001).

After the US Capitol building in Washington is evacuated (see 9:48 a.m. September 11, 2001), many members of Congress go to the nearby Capitol Police headquarters for safety, but others head elsewhere and some go home. [Daschle and D'Orso, 2003, pp. 111-112] Although the Capitol began evacuating around 9:48, no one has instructions on where to go. “Rank-and-file lawmakers didn’t have guidance from their leaders or from Capitol Police.” [Washington Post, 1/27/2002] Many of them therefore remain in the vicinity of the Capitol building. [New York Times, 9/12/2001] Senate Majority Leader Tom Daschle (D) is quickly driven away by his security detail after being evacuated from the Capitol. However, according to Daschle, the contingency plan for emergencies “directed us to convene at the Hart Senate Building, right next to the Capitol. But that was considered unsafe in this situation.” Therefore, “Some members of Congress who lived in the area decided to simply go home.” Others convene at the 116 Club, a restaurant on Capitol Hill. “The remaining senators were finally directed to the Capitol Police headquarters a block and a half away, where it was decided members of Congress would be safest. That became Congress’s central command center for the rest of the day” (see (10:00 a.m.-6:30 p.m.) September 11, 2001). However, while Daschle and some others are taken there early on (Daschle will recall being at the headquarters when the first World Trade Center tower collapses at 9:59), many others do not go there until later. [Daschle and D'Orso, 2003, pp. 111-112] Deputy Chief James Rohan of the Capitol Police keeps hearing complaints from his officers nearby the Capitol building, saying: “I’ve got all these congressmen wandering around here. What do you want me to do with them?” According to CNN, “the police assumed that those who weren’t in the [Congressional] leadership… would go home, but of course they didn’t.” Therefore, they are eventually brought to the Capitol Police headquarters as well. Several hundred members of Congress go to the headquarters during the day. [CNN, 9/11/2002] Around late morning or early afternoon, Congressional leaders leave there and are flown to a secure bunker outside Washington (see (Between Late Morning and Early Afternoon) September 11, 2001). Members of Congress who are assembled at the headquarters of the Capitol Police in Washington, DC receive regular briefings from police officers, but these reveal little more than what is being reported in the news. [Washington Post, 9/12/2001] After being evacuated from the Capitol building, many members of Congress go to the Capitol Police headquarters, located a block and a half away (see (9:55 a.m. and After) September 11, 2001). [Daschle and D'Orso, 2003, pp. 110-112] Throughout the day, several hundred of them go there, though some Congressional leaders are moved to a secure bunker outside Washington around late morning or early afternoon (see (Between Late Morning and Early Afternoon) September 11, 2001). [Washington Post, 1/27/2002; CNN, 9/11/2002] According to Senate Majority Leader Tom Daschle (D), the police headquarters becomes “Congress’s central command center for the rest of the day.” [Daschle and D'Orso, 2003, pp. 112] But, CNN will report, “In a place where power means knowing things, nobody knew very much.” Deputy Chief James Rohan of the Capitol Police later describes, “There was somebody [at the headquarters] had brought out a little four inch black and white TV with just an antenna stick on it, plugged it in, and they were getting all their information from the networks from this tiny little TV.” [CNN, 9/11/2002] The Senate and House members at the headquarters receive hourly briefings from Capitol Police officers. But, according to the Washington Post, “lawmakers privately described the sessions as ‘rudimentary,’ offering few details beyond published reports.” [Washington Post, 9/12/2001] According to Daschle, who is among those moved to the secure bunker outside Washington, members of Congress who remain at the police headquarters spend the day “crammed into several conference rooms and offices, working the telephones and watching the TV monitors for developing news,” though he gives no specific details of what they do. [Daschle and D'Orso, 2003, pp. 112] Late in the afternoon, about 50 of them speak by phone with the Congressional leaders at the secure bunker (see (5:00 p.m.) September 11, 2001), and during the evening, many of them will join the leaders on the steps of the Capitol building for a press conference (see 7:24 p.m. September 11, 2001).

[Source: Department of Homeland Security]Congressional leaders are evacuated from Washington and flown to Mount Weather, a secret and secure bunker in Virginia, where they remain until late in the afternoon. [Los Angeles Times, 9/12/2001; Washington Post, 1/27/2002; ABC News, 9/15/2002] The Capitol building was evacuated shortly after the Pentagon was hit (see 9:48 a.m. September 11, 2001). Most of the leadership teams of both parties subsequently assemble at the Capitol Police building. [Daschle and D'Orso, 2003, pp. 112] Around late morning or early afternoon, orders are given to take them to a secure location outside Washington. The Congressional leaders return to outside the Capitol building, and from there are flown by military helicopter to Mount Weather. [Washington Post, 1/27/2002] Each is allowed to bring one staff member with them. [Daschle and D'Orso, 2003, pp. 114] The Mount Weather Emergency Operations Facility in Bluemont, Virginia, is located 48 miles—about 20 minutes journey by air—from Washington. [Bulletin of the Atomic Scientists, 11/2001; ABC News, 9/15/2002] It was originally built to serve as the new seat of government if there was a nuclear war. [ABC News, 9/11/2001] The underground complex contains about 600,000 square feet of floor space, and can accommodate several thousand people. [Bulletin of the Atomic Scientists, 11/2001] It has extensive communication systems linking it to the nationwide network of Federal Emergency Management Agency (FEMA) bunkers, relocation sites, and the White House Situation Room. [Center for Land Use Interpretation Newsletter, 3/2002] Members of Congress taken to the facility include House Majority Leader Dick Armey (R), House Majority Whip Tom DeLay (R), House Minority Leader Dick Gephardt (D), House Minority Whip David Bonior (D), Senate Majority Leader Tom Daschle (D), Senate Minority Leader Trent Lott (R), Assistant Senate Majority Leader Harry Reid (D), and Senate Minority Whip Don Nickles (R). [Hastert, 2004, pp. 10] Speaker of the House Dennis Hastert was taken there earlier on (see (9:50 a.m.) September 11, 2001). [Bamford, 2004, pp. 80-81] The Congressional leaders will remain at Mount Weather until later in the afternoon, and then return to the Capitol around 6:00 p.m. (see (Between 5:00 p.m. and 6:00 p.m.) September 11, 2001). [ABC News, 9/15/2002; Daschle and D'Orso, 2003, pp. 116; Hastert, 2004, pp. 10] The decision to send them outside Washington on this day has its roots in a top secret program dating back to the cold war, which serves to ensure the “Continuity of Government” (COG) in the event of an attack on the US (see 1981-1992). [United Press International, 9/11/2001; CNN, 9/11/2002; Mann, 2004, pp. 138-139] Counterterrorism “tsar” Richard Clarke activated the COG plan shortly before 10:00 a.m. this morning (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). [Source: Publicity photo]Despite having been instructed by Vice President Dick Cheney to remain where they are, Congressional leaders who have been evacuated to a secure bunker outside Washington decide to return to the capital and are then flown back there. [Hastert, 2004, pp. 10; Lott, 2005, pp. 222] A number of members of the House and Senate leaderships were evacuated to the Mount Weather Emergency Operations Facility in Bluemont, Virginia, during the morning and early afternoon (see (9:50 a.m.) September 11, 2001 and (Between Late Morning and Early Afternoon) September 11, 2001). [ABC News, 9/15/2002] According to Senate Majority Leader Tom Daschle (D), who is among this group: “We all felt anxious and frustrated, feeling responsible as Congressional leaders to both communicate and take action, but unable to do either. We talked among ourselves of our concern for our loved ones back in Washington and our need to be with them as soon as possible.” In particular, Senate Minority Leader Trent Lott (R) begins “pressing the people around him—his own security detail and the facility’s personnel—about his strong desire to get back to Washington.” [Daschle and D'Orso, 2003, pp. 115] However, during a teleconference, Vice President Cheney told the leaders they could not leave Mount Weather (see (Between 2:50 p.m. and 4:30 p.m.) September 11, 2001). [Washington Post, 1/27/2002] Lott will recall that, in spite of this, he makes the decision to go back to Washington and arranges for this to happen: “I’d finally had enough. I told my ground security to leave for the Capitol, and now—‘because I’m not spending the night here.’ I had this decision radioed back to the vice president’s people, and the others pulling the strings. They finally relented and arranged to have us ferried back to the Capitol by helicopter.” [Lott, 2005, pp. 222] But House Speaker Dennis Hastert will say he in fact is responsible for making this decision, and that he then tells his colleagues: “Hey, it’s up to us. We need to stand together, go back to Washington and show people that we are standing together.” The leaders are flown back to Washington at around 6:00 p.m. [Daschle and D'Orso, 2003, pp. 116; Hastert, 2004, pp. 10]

[Source: US House of Representatives]Congressional leaders and about 150 other members of the House and Senate appear together on the steps of the Capitol building in Washington for a press conference, and announce that Congress will reconvene the following morning. [USA Today, 9/12/2001; Washington Post, 9/12/2001] House Speaker Dennis Hastert (R) says: “Senators and House members, Democrats and Republicans will stand shoulder to shoulder to fight this evil that has perpetrated on this nation. We will stand together to make sure that those who have brought forth this evil deed will pay the price.” Senate Majority Leader Tom Daschle (D) calls the day’s attacks “an assault on our people and on our freedom,” and says, “We, Republicans and Democrats, House and Senate, stand strongly united behind the president and we’ll work together to ensure that the full resources of the government are brought to bear in these efforts.” To applause, he announces, “Congress will convene tomorrow.” The press conference ends with the members of Congress joining together for an apparently spontaneous singing of “God Bless America.” [CNN, 9/11/2001; CNN, 9/12/2001; New York Times, 9/12/2001]

Congress explicitly refuses to grant the Bush administration the authority to conduct warrantless wiretaps and surveillance operations against US citizens in its resolution authorizing the use of military force (AUMF) against terrorists (see September 14-18, 2001). Tom Daschle (D-SD), the Senate Majority Leader, will write in December 2005 (after his ouster from Congress in November 2004) that the White House and the Justice Department will claim, falsely, that the AUMF grants the right for the NSA to conduct such a program (see Early 2002 and December 15, 2005). Instead, Daschle will write, the NSA merely usurps the authority, with the president’s approval, to conduct such an extralegal surveillance program (see December 21-22, 2005). Administration Efforts to Rewrite AUMF - In an op-ed for the Washington Post, Daschle will observe that the AUMF authorizes Bush “to use all necessary and appropriate force against those nations, organizations or persons” who “planned, authorized, committed or aided” the 9/11 attacks. But, Daschle will write, “Literally minutes before the Senate cast its vote, the administration sought to add the words ‘in the United States and’ after ‘appropriate force’ in the agreed-upon text. This last-minute change would have given the president broad authority to exercise expansive powers not just overseas—where we all understood he wanted authority to act—but right here in the United States, potentially against American citizens. I could see no justification for Congress to accede to this extraordinary request for additional authority. I refused.”
No Vote for Domestic Surveillance - Daschle will also write that the White House attempted to add draft language to the AUMF resolution that would give the administration new and sweeping authority to use force to “deter and pre-empt any future acts of terrorism or aggression against the United States,” even against nations and organizations not responsible for the 9/11 attacks. Bush officials such as Vice President Dick Cheney will claim that the AUMF “granted authority by the Congress to use all means necessary to take on the terrorists, and that’s what we’ve done.” But Daschle will write that Cheney is mistaken. “As Senate majority leader at the time, I helped negotiate that law with the White House counsel’s office over two harried days. I can state categorically that the subject of warrantless wiretaps of American citizens never came up. I did not and never would have supported giving authority to the president for such wiretaps. I am also confident that the 98 senators who voted in favor of authorization of force against al-Qaeda did not believe that they were also voting for warrantless domestic surveillance.” On September 12, six days before the September 18 AUMF vote, Bush officials demand that Congress authorize the use of military force to, in their words, “deter and pre-empt any future acts of terrorism or aggression against the United States.” But Congress refuses, feeling that the request is “too broad and ill defined.” Instead, on September 14, Congress choses to use language that authorizes Bush to use “all necessary and appropriate force against those nations, organizations or persons [the president] determines planned, authorized, committed or aided” the 9/11 attacks. Daschle later writes, “With this language, Congress denied the president the more expansive authority he sought and insisted that his authority be used specifically against Osama bin Laden and al-Qaeda.… The shock and rage we all felt in the hours after the attack were still fresh. America was reeling from the first attack on our soil since Pearl Harbor. We suspected thousands had been killed, and many who worked in the World Trade Center and the Pentagon were not yet accounted for. Even so, a strong bipartisan majority could not agree to the administration’s request for an unprecedented grant of authority.” Instead, Daschle will write, the administration simply takes the authority anyway, and will argue in hindsight that the AUMF actually gives the administration the right to wiretap US citizens. However, Daschle will write, “at the time, the administration clearly felt they [didn’t have the authority] or it wouldn’t have tried to insert the additional language.”
Breeding 'Fear and Suspicion' - He concludes, “[T]here are right and wrong ways to defeat terrorists, and that is a distinction this administration has never seemed to accept. Instead of employing tactics that preserve Americans’ freedoms and inspire the faith and confidence of the American people, the White House seems to have chosen methods that can only breed fear and suspicion. If the stories in the media over the past week are accurate [detailing the breadth and apparent illegality of the NSA program], the president has exercised authority that I do not believe is granted to him in the Constitution, and that I know is not granted to him in the law that I helped negotiate with his counsel and that Congress approved in the days after Sept. 11. For that reason, the president should explain the specific legal justification for his authorization of these actions, Congress should fully investigate these actions and the president’s justification for them, and the administration should cooperate fully with that investigation. In the meantime, if the president believes the current legal architecture of our country is insufficient for the fight against terrorism, he should propose changes to our laws in the light of day. That is how a great democracy operates. And that is how this great democracy will defeat terrorism.” [Washington Post, 12/23/2005]

The “anti-terrorism” Patriot Act is introduced in Congress on October 2, 2001 (see October 2, 2001), but it is not well received by all. [US Congress, 10/2/2001] One day later, Senate Majority Leader and future anthrax target Tom Daschle (D) says he doubts the Senate will take up this bill in the one week timetable the administration wants. As head of the Senate, Daschle has great power to block or slow passage of the bill. Attorney General John Ashcroft accuses Senate Democrats of dragging their feet. [Washington Post, 10/3/2001] On October 4, Senate Judiciary Committee Chairman and future anthrax target Patrick Leahy (D) accuses the Bush administration of reneging on an agreement on the bill. Leahy is in a key position to block or slow the bill. Some warn that “lawmakers are overlooking constitutional flaws in their rush to meet the administration’s timetable.” Two days later, Ashcroft complains about “the rather slow pace…over his request for law enforcement powers… Hard feelings remain.” [Washington Post, 10/4/2001] The anthrax letters to Daschle and Leahy are sent out between October 6-9 as difficulties in passing the Patriot Act continue (see October 6-9, 2001).

Letters containing anthrax will continue to be received until October 19. After many false alarms, it turns out that only a relatively small number of letters contain real anthrax (see October 5-November 21, 2001). [South Florida Sun-Sentinel, 12/8/2001] In 2004, Washington Post columnist Richard Cohen will recall how a widespread sense of panic spread across the US over the next few weeks, as millions felt the anthrax could target them next. He will write, “People made anthrax-safe rooms, and one woman I know of had a mask made for her small dog. I still don’t know if that was a touching gesture or just plain madness.” He says, “The [9/11] terrorist attacks coupled with the anthrax scare unhinged us a bit—or maybe more than a bit.” But he will also mention that the panic quickly passed and was largely forgotten by most people. [Washington Post, 7/22/2004] Columnist Glenn Greenwald will later comment in Salon, “After 9/11 itself, the anthrax attacks were probably the most consequential event of the Bush presidency. One could make a persuasive case that they were actually more consequential. The 9/11 attacks were obviously traumatic for the country, but in the absence of the anthrax attacks, 9/11 could easily have been perceived as a single, isolated event. It was really the anthrax letters—with the first one sent on September 18, just one week after 9/11—that severely ratcheted up the fear levels and created the climate that would dominate in this country for the next several years after. It was anthrax… that created the impression that social order itself was genuinely threatened by Islamic radicalism.” [Salon, 8/1/2008]

At least 22 more people get sick but survive. Thirty-one others test positive for exposure. As a result of these deaths and injuries, panic sweeps the nation. On October 16, the Senate office buildings are shut down, followed by the House of Representatives, after 28 congressional staffers test positive for exposure to anthrax (see October 16-17, 2001). A number of hoax letters containing harmless powder turn up, spreading the panic further. [South Florida Sun-Sentinel, 12/8/2001; Associated Press, 8/7/2008] Initially it is suspected that either al-Qaeda or Iraq are behind the anthrax letters (see October 14, 2001, October 15, 2001, October 17, 2001, and October 18, 2001). [Observer, 10/14/2001; BBC, 10/16/2001] However, by November, further investigation leads the US government to conclude that, “everything seems to lean toward a domestic source.… Nothing seems to fit with an overseas terrorist type operation (see November 10, 2001).” [Washington Post, 10/27/2001; St. Petersburg Times, 11/10/2001]

The letters are sent from a mailbox in Trenton, New Jersey. They could be sent any time after 5 p.m. on October 6 (the last pick up on the day, a Saturday), and before 5 p.m. on October 9. (There is no pickup on October 7, a Sunday, and October 8 is Columbus Day.) The letter to Daschle is opened by one of his staffers on October 15 (see October 15, 2001). It contains the message:

The writing is the same slanted, block style used in the earlier wave of anthrax letters (see September 17-18, 2001), and the content of the message is very similar. The letter to Leahy is mis-routed and not discovered until mid-November (see October 15, 2001). It contains the exact same message. Unlike the earlier wave of letters, both of these letters contain return addresses, but to bogus addresses in other New Jersey towns. On this day, Senator Tom Daschle’s office opens a letter mailed October 9, containing a lethal dose of anthrax (see October 6-9, 2001). A similar letter to Senator Patrick Leahy mailed the same day and from the same location is misrouted to Virginia on October 12, and is not discovered until November 17. Neither Leahy nor Daschle come into contact with the anthrax, but some of Daschle’s staffers do. [South Florida Sun-Sentinel, 12/8/2001]

The House of Representatives passes the final version of the Patriot Act and other previously unpopular Bush administration projects: Alaska oil drilling, $25 billion in tax cuts for corporations, taps into Social Security funds, and cuts in education. [CNN, 10/25/2001] Republican Congressman Ron Paul states: “It’s my understanding the bill wasn’t printed before the vote—at least I couldn’t get it. They played all kinds of games, kept the House in session all night, and it was a very complicated bill. Maybe a handful of staffers actually read it, but the bill definitely was not available to members before the vote.” It is later found that only two copies of the bill were made available in the hours before its passage, and most House members admit they voted for the act without actually reading it first. [Insight, 11/9/2001] Two days later, the Senate will pass the final version of the Patriot Act. Anthrax targets Senators Tom Daschle and Patrick Leahy (see October 15, 2001) now support the bill. President Bush signs it into law the same day (see October 26, 2001). [Fox News, 10/26/2001]

[Source: Mediamouse (.org)]The Family Research Council (FRC), a Christian conservative organization headed by the Reverend James Dobson, authorizes an advertisement linking Senate Majority Leader Tom Daschle (D-SD) to Saddam Hussein. The ad is triggered by Daschle’s opposition to the Bush administration’s desire to drill for oil in the protected Arctic National Wildlife Refuge (ANWR). The ad is released by American Renewal, the lobbying wing of the FRC headed by Richard Lessner, who formerly headed the editorial page staff at the Manchester Union Leader. In a press release announcing the ad, Lessner asks: “What do Saddam Hussein and Senate Majority Leader Tom Daschle have in common? Neither man wants America to drill for oil in Alaska’s Arctic National Wildlife Refuge.” It juxtaposes photos of Daschle and Hussein, and charges that American buys 725,000 barrels of oil a day from Hussein because Daschle “won’t let America drill for oil at home.” Daschle spokesman Doug Hattaway calls the ad “an outrageous, extremist attack at a time when the nation is unified.” Lessner calls the ad an example of “telling the truth” necessitating “tough talk.” Washington Post pundit Dana Milbank says the ad has all “the subtlety of a Scud missile.” [Washington Post, 11/9/2001]

Between November 10 and 12, 2001, trace amounts of anthrax are found in the offices of eleven senators. The offices infected include those of Senator Bob Graham (D), Dianne Feinstein (D), Richard Lugar (R), Barbara Boxer (D), and Jon Corzine (D). But officials say the anthrax does not threaten the health of anyone who worked or visited there. On October 15, an anthrax letter addressed to Sen. Tom Daschle (D) was opened at the Hart Senate office building (see October 15, 2001), and it is assumed the anthrax found came from this letter. [South Florida Sun-Sentinel, 12/8/2001]

Senate Democrats criticize the Bush administration’s decision to unilaterally withdraw from the 1972 Anti-Ballistic Missile (ABM) Treaty with Russia (see May 26, 1972 and December 13, 2001). Joseph Biden (D-DE), the chairman of the Senate Foreign Relations Committee, says the withdrawal will cause an arms buildup not only in Russia but in Pakistan and India, thereby increasing tensions in southern Asia. President Bush’s priorities are “out of whack,” Biden says, and adds that the US should be more worried about terrorists with weapons of mass destruction than countries with long-range ballistic missiles. “September 11 indicated our country is vulnerable,” Biden says. “The thing we remain the least vulnerable to is an ICBM attack from another nation.” Senate Majority Leader Tom Daschle warns that the withdrawal could “rupture relations with key countries around the world,” and raises questions about future arms races involving other countries. Bush officials counter that if terrorists get their hands on long-range missiles, they will use them, and the US must be prepared to defend against such an attack. [CNN, 12/14/2001]

Vice President Dick Cheney calls Democratic Senate Majority Leader Tom Daschle and urges him not to launch a 9/11 inquiry. When the call is made, Howard Fineman of Newsweek is in Daschle’s office and he hears that end of the conversation, providing important independent confirmation of Daschle’s account. Author Philip Shenon will later describe Cheney’s tone as “polite but threatening,” and Cheney reportedly tells Daschle that an investigation into 9/11 would be a “very dangerous and time-consuming diversion for those of us who are on the front lines of our response today.” Cheney also says that if the Democrats push for an investigation, the White House will portray them as undermining the war on terror. Shenon will later call this “a potent political threat” the Republicans are holding over the Democrats. President Bush repeats the request on January 28, and Daschle is repeatedly pressured thereafter. [Newsweek, 2/4/2002; Shenon, 2008, pp. 29-30, 426] Cheney will later disagree with this account: “Tom’s wrong. He has, in this case, let’s say a misinterpretation.” [Reuters, 5/27/2002]

[Source: Public domain]In February 2002, Dr. Barbara Hatch Rosenberg claims in a public speech at Princeton University that she knows the identity of the killer behind the 2001 anthrax attacks (see October 5-November 21, 2001). Rosenberg is a professor of molecular biology at the State University of New York at Purchase, and a biological arms control expert. She states: “There are a number of insiders—government insiders—who know people in the anthrax field who have a common suspect. The FBI has questioned that person more than once… so it looks as though the FBI is taking that person very seriously.” She also claims that the FBI is not that interested in going after this suspect because “[t]his guy knows too much, and knows things the US isn’t very anxious to publicize” (see February 8, 2002). In June 2002, she puts out a paper that details her theory about this suspect. She states that “a number of inside experts (at least five that I know about) gave the FBI the name of one specific person as the most likely suspect.” That same month, she presents her ideas to Senators Tom Daschle and Patrick Leahy, both of whom had been targeted in the anthrax attacks. She also is invited to brief the Senate Judiciary Committee and the Senate Intelligence Committee (see June 24, 2002). Immediately after this, the FBI searches Hatfill’s home while reporters watch, putting him in the public eye as a possible suspect (see June 25, 2002). Rosenberg later denies ever mentioning Hatfill by name. However, one reporter later claims that Rosenberg had specifically given Hatfill’s name as the lead suspect. Furthermore, the description of her suspect exactly matches Hatfill. Hatfill will later blame Rosenberg for the FBI’s interest in him. He will say: “She’s crazy. She caused it.” [Washington City Paper, 7/25/2003] In 2008, Hatfill will be officially cleared of any involvement in the anthrax attacks (see August 8, 2008).

When asked in a press conference if the success of the “war on terrorism” has been overstated, Senate Majority Leader Tom Daschle (D-SD) replies: “I don’t think the success has been overstated. But the continued success I think is still somewhat in doubt.… I will say that at this point, given the information we’ve been provided, I don’t think it would do anybody any good to second-guess what has been done to date. I think it has been successful. I’ve said that on many, many occasions. But I think the jury’s still out about future success, as I’ve said.” He adds that it would be necessary for the US to find Osama bin Laden and other al-Qaeda leaders for the “war on terrorism” to be considered a success. But despite the mild tone of these comments, Senate Minority Leader Trent Lott (R-MS) responds by saying: “How dare Senator Daschle criticize President Bush while we are fighting our war on terrorism, especially when we have troops in the field. He should not be trying to divide our country while we are united.” Senator Bill Frist (R-TN) calls Daschle’s remarks “thoughtless and ill-timed.” And Representative Tom Davis (R-VA) uses language analogous to a charge of treason, saying that that Daschle’s “divisive comments have the effect of giving aid and comfort to our enemies by allowing them to exploit divisions in our country.” [Salon, 3/1/2002] Secretary of State Colin Powell defends Daschle and other Democrats, saying: “They’re raising questions. And I think that’s what a loyal opposition does.” The Washington Post editorial board criticizes the Republican response, saying that the US “would be a weaker country if Sen. Lott succeed[s] in choking off debate.” But Lott refuses to apologize, and says that “any sign that we are losing that unity, or crack in that support, will be, I think, used against us overseas.” [New York Times, 3/1/2002; Salon, 3/5/2002]

President Bush invites a group of congressional leaders to have breakfast with him and Cheney in the White House’s private dining room to discuss Iraq. Present at the meeting are Senate Majority Leader Tom Daschle, Senate Minority Leader Trent Lott, Speaker of the House Dennis Hastert, and House Minority Leader Dick Gephardt. Bush tells the lawmakers that he needs a Congressional resolution authorizing military force against Iraq, and he needs it soon. During the meeting, Daschle suggests that it would be better to postpone the debate on such a resolution until after the November elections, so as to take politics out of the equation (see September 19, 2002). According to Daschle, Bush looks at Cheney, who replies with a “half smile.” Then Bush answers, “We just have to do it now.” [New York Times, 9/7/2002; Dean, 2004, pp. 140; Isikoff and Corn, 2006, pp. 23] After the meeting, the lawmakers pass the word that Bush implied new intelligence about Iraq’s nuclear weapons program would be forthcoming. That new information never materializes. [Dean, 2004, pp. 140] In the upcoming days, many Democrats will accuse the Bush administration of attempting to “politicize” the debate on the resolution in order to impact the upcoming midterm elections (see September 25, 2002 and September 26, 2002).

Vice President Dick Cheney and CIA Director George Tenet meet with senators Trent Lott (R-Miss), Tom Daschle (S-SD), Dennis Hastert (R-Ill), and Richard Gephardt (D-Mo) and, in the words of Cheney, “share the most sensitive information [on Iraq’s alleged WMDs] with them.” [New York Times, 9/7/2002; Isikoff and Corn, 2006, pp. 30] They show blurry satellite photos of buildings or warehouses that Cheney insists are Iraqi nuclear weapons sites, and shots of drone aircraft presumably capable of attacking Israel with biological and chemical weapons. They also share sketches of tractor trailers that Tenet says are mobile biological weapons factories. Daschle, a former Air Force photo analyst intelligence officer, is skeptical of the photos, but says nothing. [Isikoff and Corn, 2006, pp. 30]

Condoleezza Rice and George Tenet give a classified briefing to some members of Congress in an attempt to persuade them of the immediate need to invade Iraq (see September 19, 2002 and September 24, 2002). After the briefing, several Democrats say they are unconvinced that Saddam Hussein poses an imminent threat to the US; some intimate that the White House is trying to “politicize” the debate on the resolution in order to impact the elections. Minority Whip Nancy Pelosi (D-CA), the ranking Democrat on the House Intelligence Committee, says, “I know of no information that the threat is so imminent from Iraq” that Congress cannot wait until January to vote on a resolution. “I did not hear anything today that was different about [Saddam Hussein’s] capabilities,” save a few “embellishments.” She is joined by Tom Lantos (D-CA), a hawkish Democrat who supports the overthrow of the current Iraq regime, but who wants a special session of Congress after the November 5 elections to debate a war resolution. “I do not believe the decision should be made in the frenzy of an election year,” he says. Senator Dick Durbin (D-IL) agrees: “It would be a severe mistake for us to vote on Iraq with as little information as we have. This would be a rash and hasty decision” because the administration has provided “no groundbreaking news” on Iraq’s ability to strike the United States or other enemies with chemical, biological or nuclear weapons. Durbin’s fellow senator, Evan Bayh (D-IN) adds that while he agrees Iraq is a valid threat, the White House must do more to convince lawmakers and the American people of that threat before asking Congress to approve military action. “If the president wants to have a vote before the election, he needs to give the military threat, or he risks looking political. With that timing, he will run the risk of looking brazenly political,” Bayh says. Senator Robert Menendez (D-NJ) agrees with Pelosi and Durbin, saying, “What was described as new is not new. It was not compelling enough” to justify war. “Did I see a clear and present danger to the United States? No.” Senate Majority Whip Harry Reid (D-NV) favors delaying the vote as well, but Daschle says he will likely allow the Senate to vote on the resolution if Bush meets several criteria, including obtaining more international support for a military campaign and providing senators a more detailed explanation of how the war would be conducted and how Iraq would be rebuilt. House Majority Leader Dick Armey (R-TX) is one of the very few Republicans to oppose the resolution coming up for a vote before the elections. Most Republicans agree with Senate Minority Leader Trent Lott (R-MS), who wants the White House to submit a specific war resolution by September 23 so it can be voted on before the October adjournment. But an unnamed House Republican leader also seems to believe the case Tenet and Rice presented is weak: he says, “Daschle will want to delay this and he can make a credible case for delay.” [Washington Post, 9/10/2002; CNN, 9/10/2002; CNN, 9/11/2002]

Senate Majority Leader Tom Daschle (D-SD) accuses Vice President Dick Cheney of politicizing the Iraq debate by urging an audience in Kansas to vote for a GOP congressional candidate because he supports President Bush on the issue (see September 10, 2002 and September 24, 2002). Dashcle says, “I must say that I was very chagrined that the vice president would go to a congressional district yesterday and make the assertion that somebody ought to vote for this particular Republican candidate because he was a war supporter and that he was bringing more support to the president than his opponent. If that doesn’t politicize this war, I don’t know what does.” Cheney was campaigning on behalf of Republican House candidate Adam Taff, running against incumbent Democrat Dennis Moore. Cheney told the audience of Taff supporters that the US “must not look the other way as threats gather against the American people” and that the “entire world knows beyond dispute that Saddam Hussein holds weapons of mass destruction in large quantities.… President Bush and I are grateful for the opportunity to serve our country. We thank you for your support—not just for our efforts, but for good candidates like Adam Taff who will be a fine partner for us in the important work ahead.” Senator Dick Durbin (D-IL) says, “It goes to the question of what the goal is here. Is it regime change in Iraq or regime change in the Senate?… If this is really designed to be dragged out to get it closer to the election and to obscure every other issue including the limited success of our war against terrorism and the economy, then I don’t give it much hope.” [CNN, 9/25/2002]

[Source: Salon]Senate Majority Leader Tom Daschle blasts the Bush administration for trying to use the debate over the Iraq war resolution for political purposes, and for smearing the patriotism of Democrats who question the need for the resolution. After reading through a number of statements by White House and Congressional Republicans, including one from President Bush who said Senate Democrats were “not interested in the security of the American people,” the usually conciliatory and soft-spoken Daschle retorts, “‘Not interested in the security of the American people’? You tell Senator [Daniel] Inouye he’s not interested in the security of the American people. You tell those who fought in Vietnam and in World War II they’re not interested in the security of the American people. That is outrageous. Outrageous. The president ought to apologize.” Inouye (D-HI) lost his arm while fighting in World War II. Daschle also cites a Republican pollster who says war as a political issue could tip the elections in favor of the Republicans, references Dick Cheney’s use of Iraq as an issue to promote the campaign of a GOP House candidate in Kansas (see September 25, 2002), and recalls White House Chief of Staff Andrew Card’s statement that “from a marketing point of view,” it makes sense to raise the issue of Iraq after Labor Day when lawmakers would be back from their August break (see September 6, 2002). White House press secretary Ari Fleischer counters that Daschle is taking Bush’s comment out of context, and is relying on erroneous or misleading press releases to make his charges. Fleischer advises to “take a deep breath,” “stop finger-pointing,” and join Bush in “protect[ing] our national security and our homeland defense.” Daschle responds to Fleischer’s comments by saying there is “no context” in which Bush or any other Republican can fairly question whether Senate Democrats are interested in national security. He says the White House’s explanation of Bush’s remarks are “not worth the paper they’re printed on.” Senate Minority Leader Trent Lott (R-MS) charges that Daschle and his fellow Democrats are unfairly attacking the president. “Who is the enemy here, the president of the United States or Saddam Hussein? [Daschle] needs to cool the rhetoric.” Senator Robert Byrd (D-WV) retorts, “There is nothing more sobering than the decision to go to war. But the administration has turned the decision into a bumper-sticker election theme.” [CNN, 9/26/2002]

During a breakfast meeting with congressional leaders, President Bush says there is no point trying to talk to Saddam Hussein. “Do you want to know what the foreign policy of Iraq is to the United States?” he asks Senator Tom Daschle (D-SD), according to someone who was present at the meeting. Then, thrusting his middle finger in the senator’s face, he says, “F_ck the United States! That’s what it is—that’s why we’re going to get him!” [Isikoff and Corn, 2006, pp. 116-117]

Congress approves legislation creating an independent commission—the National Commission on Terrorist Attacks Upon the United States—which will later be popularly known as the 9/11 Commission. The Commission’s mandate is to “examine and report on the facts and causes relating to the September 11th terrorist attacks” and “make a full and complete accounting of the circumstances surrounding the attacks.” President Bush signs it into law November 27, 2002. [US Congress, 11/27/2002] Bush originally opposed an independent commission (see May 23, 2002), but changed his mind over the summer (see September 20, 2002) after political pressure. The Democrats conceded several important aspects of the Commission (such as subpoena approval) after the White House threatened to create a Commission by executive order, over which it would have more control. Bush will appoint the Commission chairman and he sets a strict time frame (18 months) for its investigation. [CNN, 11/15/2002] The Commission will only have a $3 million budget. Senator Jon Corzine (D) and others wonder how the Commission can accomplish much with such a small budget. [Associated Press, 1/20/2003] (In contrast, a 1996 federal commission investigating casino gambling received $5 million; the federal government spent $50 million investigating Bill Clinton and Whitewater; and the investigation into the February 2003 Columbia shuttle explosion will receive $50 million.) [Carter, 2004, pp. 280] Senate Majority Leader Tom Daschle (D) will call the budget “a joke.” [Shenon, 2008, pp. 31] The budget will later be increased (see March 26, 2003).

Conservative radio talk show host Rush Limbaugh excoriates Senate Majority Leader Tom Daschle (D-SD), accusing him of attempting to “destroy this country” by questioning the Bush administration’s rationale for war with Iraq (see September 25, 2002 and September 26, 2002). Limbaugh directly impugns Daschle’s patriotism, accusing him of being a traitor and comparing him to “Hanoi Jane” Fonda and World War II’s Japanese propaganda maven, Tokyo Rose. “What more do you want to do to destroy this country than what you’ve already done?” Limbaugh shouts. “It is unconscionable what this man has done! This stuff gets broadcast around the world, Senator. What do you want your nickname to be? Hanoi Tom? Tokyo Tom?… You sit there and pontificate on the fact that we’re not winning the war on terrorism when you and your party have done nothing but try to sabotage it.” One of Limbaugh’s callers accuses Daschle and the Democrats of giving “aid and comfort to the enemy”—a legal definition of treason—and says of Daschle, “He’s not interested in the safety of this country.” [Jamieson and Cappella, 2008, pp. 156-157]

Senate Majority Leader Tom Daschle (D-SD) responds to conservative radio host Rush Limbaugh’s accusations that Daschle and Congressional Democrats are guilty of treason by not supporting the Bush administration’s push for war with Iraq (see November 15, 2002). Daschle calls Limbaugh “and all of the Rush Limbaugh wannabees” of having “a shrill edge,” and says of his listeners: “They want to act because they get emotionally invested. And so, you know, the threats to us in public life go up dramatically (see October 5-November 21, 2001), and on our families and on us in a way that’s very disconcerting. You know, we see it in foreign countries. And we think, well my God, how can this religious fundamentalism become so violent? Well, it’s the same shrill rhetoric. It’s that same shrill power that motivates. They—you know, they—that somebody says something, and then it becomes a little more shrill the next time, and then more shrill the next time.” Some media observers, such as the Washington Post’s Howard Kurtz, later say that such responses from their political targets merely elevate figures such as Limbaugh in their listeners’ eyes. [Jamieson and Cappella, 2008, pp. 157]

The 9/11 Commission begins to look for ways to get rid of one of its members, Democrat Max Cleland, who the other commissioners have come to dislike.
Accusations of Partisanship - According to author Philip Shenon, some of the Commission’s members feel that Cleland has been “so combative and harshly partisan in the Commission’s early private meetings—so angry at the mention of the names of [George W.] Bush or [Karl] Rove, so obsessed with what was happening in Iraq—that it threatened any hope of a unanimous final report.” Cleland’s stance is apparently influenced by his recent election defeat, which he blames on what he regards as a smear campaign led by Rove and Bush (see October 11, 2002 and After). Fellow commissioner Slade Gorton will say, “Max Cleland is an extremely embittered individual, and all he wanted to do was ‘get’ the president.”
Appointment to Federal Agency - Therefore, Tom Kean, the Commission’s chairman, and other commissioners begin to look for a way to remove Cleland from the investigation. However, these moves have to be conducted in secret, as Cleland is known to the victims’ family members as a harsh critic of the White House. If news of plans to remove him leaked, it would lead to a firestorm of criticism. Kean therefore calls Democratic Senate Minority Leader Tom Daschle, who arranged Cleland’s position on the Commission. In July, Daschle will put Cleland forward as a Democratic member of the board of the Export-Import Bank, a federal agency that helps US exports. The lucrative position would be markedly advantageous to Cleland, a severely injured war veteran with no stable source of income. Although the White House does not like Cleland, it will agree to appoint him to the board so that he can be removed from the Commission. However, this will not occur until December (see December 9, 2003). [Shenon, 2008, pp. 160-162]

[Source: C-SPAN / Media Bistro]Gay prostitute James Guckert, who moonlights as conservative “journalist” Jeff Gannon (see January 26, 2005), writes a series of articles for the conservative Internet news site Talon News in an attempt to discredit the South Dakota Argus Leader and its veteran political writer, David Kranz. Gannon/Guckert writes a series of articles falsely alleging that Kranz, who had gone to college with Senator Tom Daschle (D-SD), was not only sympathetic to Daschle’s re-election campaign, but was actually working for Daschle. (The National Journal later writes that the blog assault “opened a new and potentially powerful front in the war over public opinion.”) The stories get a tremendous amount of play on right-wing blogs and conservative news Web sites, and the resulting barrage of complaints to the Argus Leader results in that newspaper altering its coverage to more strongly favor Daschle’s opponent, Republican John Thune. Thune’s campaign manager Dick Wadham is an old political crony of White House political guru Karl Rove. Several of the so-called “independent” bloggers decrying the Argus Leader’s coverage are actually working for Wadham. The bloggers and Gannon/Guckert continue their string of allegations, with Gannon/Guckert alleging that Daschle had claimed an improper tax exemption on his Washington home, a story instantly picked up on by Wadham’s cadre of “independent” bloggers. Thune uses the story as the basis of a political ad claiming Daschle is a resident of Washington, not South Dakota. Daschle aides call Gannon/Guckert “the dumping ground for opposition research.” Gannon/Guckert, who also hosts an Internet radio show called “Jeff Gannon’s Washington,” has Thune on as a guest; already having some experience as a member of the White House press corps (see February 18, 2005), he is touted as South Dakota’s “resident DC expert” by Wadham’s paid bloggers. Thune, who narrowly defeats Daschle, later gives interviews touting the impact of independent Internet bloggers and correspondents—without revealing the fact that neither Gannon/Guckert nor the bloggers were actually independent agents. [CBS News, 2/18/2005; Salon, 2/18/2005]

A group including former Secretary of State Madeleine Albright and former National Security Adviser Sandy Berger issues a report entitled “An American Security Policy.” The report, commissioned by Senate Minority Leader Tom Daschle (D-SD), lists six areas of security concerns ranked in their order of importance. Leading the field is the section called “The Loose Nukes Crisis in North Korea.” The second most pressing concern, the report says, is the unsecured nuclear, chemical, and biological weapons in Russia and the former Soviet states. Iraq is ranked fourth. [Carter, 2004, pp. 19]

Vice President Dick Cheney gives the Congressional leaders known as the “Gang of Eight”—the House Speaker and House Minority Leader, the Senate Majority and Minority Leaders, and the ranking members of the House and Senate intelligence committees—their first briefing on the NSA’s warrantless wiretapping program (see Early 2002). Senate Minority Leader Tom Daschle (D-SD) later recalls the meeting as superficial. Cheney “talked like it was something routine,” Daschle will say. “We really had no idea what it was about.” Unbeknownst to many of the Congressional leaders, White House and Justice Department leaders are locked in a sharp dispute over whether or not the program is legal and should be continued; Cheney is preparing to send White House counsel Alberto Gonzales and chief of staff Andrew Card to Attorney General John Ashcroft’s hospital room to persuade the gravely ill and heavily sedated Ashcroft to overrule acting attorney general James Comey and reauthorize the program (see March 10-12, 2004). The briefing is designed to give the appearance of Congressional approval for the program. While most Republicans in the briefing give at least tacit approval of the program, some Democrats, as Daschle will later recall, express “a lot of concerns” over the program’s apparent violation of fundamental Congressional rights. House Minority Leader Nancy Pelosi later recalls that she “made clear my disagreement with what the White House was asking.” But administration officials such as Gonzales will later say (see July 24, 2007) that the eight Congressional leaders are in “consensus” in supporting the program, a characterization that is patently false (see July 25, 2007.) Gonzales will also later testify that this briefing did not cover the NSA wiretapping program, later dubbed the “Terrorist Surveillance Program” (TSP), another apparent falsehood contradicted by Democratic senators such as Russ Feingold and Jay Rockefeller, as well as testimony and notes on the hospital room visit made by FBI director Robert Mueller and a memo from John Negroponte, the Director of National Intelligence. Many feel that Gonzales is using the moniker “Terrorist Surveillance Program,” not in use until December 2005, to play what Newsweek reporter Michael Isikoff calls “verbal parsing” and “a semantic game”—since the NSA wiretapping program was not known by that name at the time of the Congressional briefing, Gonzales will imply that the briefing wasn’t about that program. Domestic Surveillance Began Before 9/11? - Cheney fails to inform the lawmakers that the wiretapping program may have begun well before the 9/11 attacks (see Late 1999, February 27, 2000, December 2000, February 2001, February 2001, Spring 2001, July 2001, and Early 2002).

Investigative reporters for CBS and other mainstream outlets find ties between faux journalist “Jeff Gannon” (see January 26, 2005) and White House political guru Karl Rove. Gannon, a conservative Internet “reporter” and gay male escort whose real name is James Guckert, says he only met Rove once, at a White House Christmas party. But the ties between Gannon/Guckert and Rove run much deeper. Circumstantial evidence includes the ease with which Gannon/Guckert obtained White House press corps day passes, and the fact that Rove has talked with the extremist Internet political organization GOPUSA, which owns Talon News. Gannon/Guckert formerly wrote for Talon. Both GOPUSA and Talon are owned by Bobby Eberle, a Texas Republican and business associate of conservative direct-mail guru Richard Viguerie. Bobby Eberle has boasted of Talon’s “conservative slant” and GOPUSA’s “instant built-in bias.” Gannon/Guckert also played a key role in the defeat of former Senate Majority Leader Tom Daschle (D-SD) in his 2004 bid to keep his Senate seat (see Summer 2003 - November 2004). CBS political editor Dotty Lynch calls Gannon/Guckert and Talon News “mini-Drudge Reports: a ‘news’ source which partisans use to put out negative information, get the attention of the bloggers, talk radio, and then the [mainstream media] in a way that mere press releases are unable to achieve.” [CBS News, 2/18/2005] Eberle has posted what author and media critic Frank Rich later calls “effusive thanks on the Web to both [talk show host G. Gordon] Liddy and Karl Rove ‘for their assistance, guidance, and friendship.’” [Rich, 2006, pp. 171]

Former Senate Majority Leader Tom Daschle (D-SD) writes that Congress explicitly rejected several attempts by the Bush administration to provide him with war-making authority and the authority to wiretap and monitor US citizens “in the United States” when it approved the September 18, 2001 authorization to use military force (AUMF) against terrorists (see September 14-18, 2001). Instead, the Bush administration merely usurped that authority and launched—or expanded (see Spring 2001)—its warrantless wiretapping program, conducted by the NSA. Since then, the Bush administration and the Justice Department have both repeatedly asserted that the AUMF gave them the right to conduct the wiretapping program, an assertion that Daschle says is flatly wrong. On December 21, the Justice Department admitted in a letter that the October 2001 presidential order authorizing warrantless eavesdropping on US citizens did not comply with “the ‘procedures’ of” the law that has regulated domestic espionage since 1978, known as the Foreign Intelligence Surveillance Act (FISA). FISA established a secret intelligence court and made it a criminal offense to conduct electronic surveillance without a warrant from that court, “except as authorized by statute.” However, the letter, signed by Assistant Attorney General William Moschella, argues that the AUMF gave the administration the authority to conduct the program. [Washington Post, 12/22/2005] The letter continues the argument that Congress gave President Bush the implict authority to create an exception to FISA’s warrant requirements, though the AUMF resolution did not mention surveillance and made no reference to the president’s intelligence-gathering authority. The Bush administration kept the program secret until it was revealed by the New York Times on December 15, 2005. Moschella argues that secret intelligence-gathering, even against US citizens, is “a fundamental incident to the use of military force” and that its absence from the resolution “cannot be read to exclude this long-recognized and essential authority to conduct communications intelligence targeted at the enemy.” Such eavesdropping, he argued, must by necessity include conversations in which one party is in the United States. [William Moschella, 12/22/2005 pdf file] Daschle, one of the primary authors of the resolution, says that Moschella and the Bush administration are wrong in their assertions: “I did not and never would have supported giving authority to the president for such wiretaps. I am also confident that the 98 senators who voted in favor of authorization of force against al-Qaeda did not believe that they were also voting for warrantless domestic surveillance” (see September 12-18, 2001). The Justice Department opens an investigation into the leak of classified information about the Bush domestic surveillance program. The investigation focuses on disclosures to the New York Times about the secret warrantless wiretapping program conducted by the National Security Agency since shortly after the 9/11 attacks (see Early 2002). The White House claims that the Justice Department initiated the investigation on its own after receiving a request from the NSA, and that it was not even informed of the investigation until the decision had already been made. But White House spokesman Trent Duffy hails the investigation, and implicitly accuses the Times of aiding and abetting terrorists by printing its stories. “The leaking of classified information is a serious issue,” Duffy says. “The fact is that al-Qaeda’s playbook is not printed on Page One, and when America’s is, it has serious ramifications.” [Associated Press, 12/30/2005] President Bush fuels the attack on the Times when he says, “The fact that we’re discussing this program is helping the enemy.” [New York Times, 12/30/2005] Many outside of the administration have accused the wiretapping program, which functions without external oversight or court warrants, of being illegal, and Bush of breaking the law by authorizing it. Administration officials insist that Bush has the power to make such a decision, both under the Constitution’s war powers provision and under the post-9/11 Congressional authorization to use military force against terrorism, even though, as former Senate Majority Leader Tom Daschle recalls, Congress explicitly refused to give Bush the authority to take military action inside the US itself (see December 21-22, 2005). And, in a recent letter to the chairs of the House and Senate Intelligence Committees, the White House claimed that the nation’s security needs outweigh the needs of the citizenry to be secure from secret government surveillance. [Associated Press, 12/30/2005] Others disagree. The American Civil Liberties Union’s Anthony Romero says, “President Bush broke the law and lied to the American people when he unilaterally authorized secret wiretaps of US citizens. But rather than focus on this constitutional crisis, Attorney General [Alberto] Gonzales is cracking down on critics of his friend and boss. Our nation is strengthened, not weakened, by those whistle-blowers who are courageous enough to speak out on violations of the law.” And Marc Rotenberg, the executive director of the Electronic Privacy Information Center, says the NSA should be the focus of an investigation to determine if it broke federal surveillance laws. Tom Devine of the Government Accountability Project suggests a middle course. His group does not object to a limited investigation into the leak of classified information, but, he says, if the administration does “a blanket witch hunt, which I fear, it would trample all over good government laws” designed to protect government workers who expose wrongdoing. “The whole reason we have whistle-blower laws is so that government workers can act as the public’s eyes and ears to expose illegality or abuse of power.” [New York Times, 12/30/2005] Ultimately, this leak investigation may not achieve much, according to law professor Carl Tobias. “It doesn’t seem to me that this leak investigation will take on the importance of the Plame case,” Tobias says. “The bigger story here is still the one about domestic spying and whether the president intends, as he said, to continue doing it.” [Washington Post, 12/31/2005]

New documents contradict Attorney General Alberto Gonzales’s recent sworn testimony before the Senate Judiciary Committee, indicating that Gonzales may have committed perjury before the panel.
Lied About Congressional Briefing - In testimony before the committee (see July 24, 2007), Gonzales told senators that a March 10, 2004 emergency briefing with the so-called “Gang of Eight,” comprised of the Republican and Democratic leaders of the two houses of Congress and the ranking members of both houses’ intelligence committees (see March 10, 2004), did not concern the controversial NSA warrantless domestic surveillance program, but instead was about other surveillance programs which he was not at liberty to discuss. But according to a four-page memo from the national intelligence director’s office, that briefing was indeed about the so-called “Terrorist Surveillance Program,” or TSP, as it is now being called by White House officials and some lawmakers. The memo is dated May 17, 2006, and addressed to then-Speaker of the House Dennis Hastert. It details “the classification of the dates, locations, and names of members of Congress who attended briefings on the Terrorist Surveillance Program,” wrote then-Director of National Intelligence John Negroponte. The DNI memo provides further evidence that Gonzales has not been truthful in his dealings with Congress, and gives further impetus to a possible perjury investigation by the Senate. So far, both Gonzales and Justice Department spokesmen have stood by his testimony. The nature of the March 2004 briefing is important because on that date, Gonzales and then-White House chief of staff Andrew Card tried to pressure then-Attorney General John Ashcroft, while Ashcroft was recuperating from emergency surgery in the hospital, to reauthorize the domestic wiretapping program over the objections of acting Attorney General James Comey, who had refused to sign off on the program due to its apparent illegality (see March 10-12, 2004). Comey’s own testimony before the Senate has already strongly contradicted Gonzales’s earlier testimonies and statements (see May 15, 2007). The entire imbroglio illustrates just how far from legality the NSA wiretapping program may be, and the controversy within the Justice Department it has produced. Gonzales flatly denied that the March 2004 briefing was about the NSA program, telling the panel, “The dissent related to other intelligence activities. The dissent was not about the terrorist surveillance program.”
Grilled By Senators - Senator Charles Schumer (D-NY) pressed Gonzales for clarification: “Not the TSP? Come on. If you say it’s about other, that implies not. Now say it or not.” Gonzales replied, “It was not. It was about other intelligence activities.” Today, with the DNI documents in hand, Schumer says, “It seemed clear to just about everyone on the committee that the attorney general was deceiving us when he said the dissent was about other intelligence activities and this memo is even more evidence that helps confirm our suspicions.” Other senators agree that Gonzales is not telling the truth. “There’s a discrepancy here in sworn testimony,” says committee chairman Patrick Leahy (D-VT). “We’re going to have to ask who’s telling the truth, who’s not.” And committee Democrats are not the only ones who find Gonzales’s testimony hard to swallow. Arlen Specter (R-PA) told Gonzales yesterday, “I do not find your testimony credible, candidly.” The “Gang of Eight” members disagree about the content of the March briefing. Democrats Nancy Pelosi, Jay Rockefeller, and Tom Daschle all say Gonzales’s testimony is inaccurate, with Rockefeller calling Gonzales’s testimony “untruthful.” But former House Intelligence chairman Porter Goss and former Senate Majority Leader Bill Frist, both Republicans, refuse to directly dispute Gonzales’s claims. Mueller Will Contradict Gonzales - Three weeks later, notes from FBI director Robert Mueller, also present at the Ashcroft meeting, further contradict Gonzales’s testimony (see August 16, 2007).

Cappella, authors of the media study Echo Chamber: Rush Limbaugh and the Conservative Media Establishment, find that conservative radio host Rush Limbaugh excels at using what they call “insider language” for his listeners “that both embeds definitional assumptions hospitable to his conservative philosophy and makes it difficult for those who embrace the language to speak about Democrats and the presumed Democratic ideology without attacking them.” They cite three examples from Limbaugh’s June 2005 newsletter which contains the following statements:
bullet “Democrats are the enemy.”
bullet “When she first ran for her Senate seat, Hillary Rodham Clinton told citizens of the Empire State [New York] that she had been endorsed by environmental wacko-groups because… in her words, ‘I’ve stood for clean air.’”
bullet After Harvard president Lawrence Summers commented on the intrinsic differences between the sexes, Limbaugh wrote, “Led by foaming-at-the-mouth feminists, the liberal elite experienced a mass politically correct tantrum.”
Jamieson and Cappella write: “Identifying terms such as ‘foaming-at-the-mouth feminists,’ ‘liberal elite,’ ‘enemy,’ and ‘environmental wacko-groups’ both create an insider language and distance those who adopt the labels from those labeled. One of the ways Limbaugh’s supporters telegraph their identification with him is by adopting his language.”
Identifying Nicknames - They cite the 1995 statement of freshman House Representative Barbara Cubin (R-WY), who proudly proclaimed of her fellow female Republicans, “There’s not a femi-Nazi among us,” using one of Limbaugh’s favorite terms for feminists. “Listeners say ‘Ditto’ or ‘megadittoes’ to telegraph their enthusiasm for Limbaugh, his latest argument, or his show in general,” they write. Limbaugh refers to himself as “the MahaRushie” with “talent on loan from God.” Callers often refer to Limbaugh as “my hero.” Denigrating nicknames for Limbaugh’s targets of derision work to bring listeners into the fold: the new listener must labor to identify the people termed (and thusly become part of the Limbaugh community): “Clintonistas” (supporters of Bill and/or Hillary Clinton), “Sheets” (Senator Robert Byrd, D-WV), who in his youth wore ‘sheets’ as a Ku Klux Klan member), “the Swimmer” (Senator Edward Kennedy, D-MA, in reference to his involvement in the 1969 Chappaquiddick incident), “Puffster” (former Senator Tom Daschle, D-SD), “the Breck Girl” (former Senator John Edwards, D-NC), and “Ashley Wilkes” (retired General Wesley Clark, in a reference to what Limbaugh called “the wimpy, pathetic Gone with the Wind character”). Some of the nicknames are physically derogatory: Senator Patrick Leahy (D-VT) became “Senator Leaky, a.k.a. Senator Depends,” and former House Minority Leader Richard Gephardt (D-MO) became “‘Little Dick’ Gephardt.” Such use of “insider” nicknames indicates an identification between the listener and Limbaugh, and an affiliation with the Limbaugh community of supporters.
Redefining and Relabeling - Limbaugh routinely redefines and relabels his political enemies in the most derogatory terms. Pro-choice supporters are termed “pro-aborts,” and Democrats are supported by “beggar-based constituencies.” As noted above, feminists are “femi-Nazis” (though Jamieson and Cappella note that Limbaugh has used the term less often since it became a topic of criticism in the mainstream media).
Gender Identification - One of Limbaugh’s strongest attacks is on gender roles. In Limbaugh’s continuum, Democratic women are, the authors write, “either sexualized manipulators or unattractive man haters.” A 1994 Clinton tribute to women’s accomplishments became, in Limbaugh’s words, “Biddies’ Night Out.” Other times, Democratic women become “babes,” as in “Congressbabe Jane Harman.” (On his Web site, Limbaugh often shows Speaker of the House Nancy Pelosi (D-CA)‘s head affixed to the body of a Miss America contender.) The authors note, “Neither label invites the audience to take these leaders seriously.” Women with whom he disagrees, such as liberal blogger Arianna Huffington, are “screeching,” and others are “broads,” “lesbians,” or “femi-Nazis.” The National Organization for Women (NOW) becomes, in Limbaugh’s vocabulary, the NAGS. Attacks and innuendo about women’s sexuality are frequently used by Limbaugh: during the Clinton administration, for example, Limbaugh often implied that Hillary Clinton and then-Attorney General Janet Reno were closeted lesbians. On the other hand, Democratic men are routinely portrayed as “two-inchers,” derogatory references to their physical attributes and sexual capabilities (as with the Gephardt nickname above). Jamieson and Cappella note that “Limbaugh’s attempts at gender-based humor are of the locker room variety,” noting several references to California Lieutenant Governor Cruz Bustamante as a Democrat whose name translates into “large breasts,” and referring to pop singer Madonna’s 2004 endorsement of General Wesley Clark for president by saying she had “opened herself” to Clark. In 2004, he said that Democratic presidential contender John Kerry, married to wealthy heiress Teresa Heinz-Kerry, “does his fundraising every night when he goes to bed.” (The authors write, “Why the vulgarity in this message does not alienate the churchgoing conservatives in his audience is a question for which we have no ready answer.”)
Impact - Far from merely giving a laundry list of Limbaugh’s derogatory and offensive characterizations, Jamieson and Cappella note how Limbaugh and the conservative media “wrap their audiences in a conversation built on words and phrases that embody conservatism’s ideological assumptions,” using “naming and ridicule to marginalize those named as part of an out-group,” and using “coherent, emotion-evoking, dismissive language” to denigrate and dismiss the liberals he routinely attacks. “Because language does our thinking for us,” they write, “this process constructs not only a vocabulary but also a knowledge base for the audience. That language and the view of the world carried by it are presumed by loyal conservatives and alien to the nonconservative audience. These interpretations of people and events also reinforce Limbaugh’s defense of conservatism and its proponents.” [Washington Post, 2/15/1995; Jamieson and Cappella, 2008, pp. 184-190]

The Justice Department gives a private briefing to some Congresspeople and government officials outlining the FBI’s case against deceased anthrax attacks suspect Bruce Ivins. Sen. Tom Daschle (D), a target of one of the 2001 anthrax letters, attends the briefing and is impressed with the FBI’s arguments. He says that prior to the briefing, he was “very dubious,” but now he finds the government’s case “complete and persuasive.” [USA Today, 8/13/2008] However, Daschle’s reaction seems to be unusual. The New York Times reports that “a number of listeners said the briefing left them less convinced that the FBI had the right man, and they said some of the government’s public statements appeared incomplete or misleading.” Representative Rush Holt (D) says, “The case is built from a number of pieces of circumstantial evidence, and for a case this important, it’s troubling to have so many loose ends. The briefing pointed out even more loose ends than I thought there were before.” Naba Barkakati, the chief technologist for the Government Accountability Office (GAO), says: “It’s very hard to get the sense of whether this was scientifically good or bad. We didn’t really get the question settled, other than taking their word for it.” As a result of these continuing doubts, the FBI decides to make public more details of their scientific evidence against Ivins in a press conference to be held a week later. [New York Times, 8/15/2008]

Betsy McCaughey (R-NY), the former lieutenant governor of New York and a fellow at the conservative Hudson Institute, writes that health care provisions in the Obama administration’s economic stimulus plan will affect “every individual in the United States.” McCaughey writes: “Your medical treatments will be tracked electronically by a federal system. Having electronic medical records at your fingertips, easily transferred to a hospital, is beneficial. It will help avoid duplicate tests and errors. But the bill goes further. One new bureaucracy, the National Coordinator of Health Information Technology, will monitor treatments to make sure your doctor is doing what the federal government deems appropriate and cost effective. The goal is to reduce costs and ‘guide’ your doctor’s decisions.” McCaughey says the provisions are similar to suggestions in the book Critical: What We Can Do About the Health Care Crisis, by former Senate Majority Leader Tom Daschle (D-SD), until recently Obama’s pick to head the Department of Health and Human Services. McCaughey writes that hospitals and doctors who do not use the system will be punished, by a federal oversight board to be called the Federal Coordinating Council for Comparative Effectiveness Research. Perhaps most worrisome is McCaughey’s claim that elderly Americans will be given reduced health care based on their age and expected productivity. “Medicare now pays for treatments deemed safe and effective. The stimulus bill would change that and apply a cost-effectiveness standard set by the Federal Council,” she writes. “The Federal Council is modeled after a UK board discussed in Daschle’s book. This board approves or rejects treatments using a formula that divides the cost of the treatment by the number of years the patient is likely to benefit. Treatments for younger patients are more often approved than treatments for diseases that affect the elderly, such as osteoporosis. In 2006, a UK health board decreed that elderly patients with macular degeneration had to wait until they went blind in one eye before they could get a costly new drug to save the other eye. It took almost three years of public protests before the board reversed its decision.… If the Obama administration’s economic stimulus bill passes the Senate in its current form, seniors in the US will face similar rationing. Defenders of the system say that individuals benefit in younger years and sacrifice later. The stimulus bill will affect every part of health care, from medical and nursing education, to how patients are treated and how much hospitals get paid. The bill allocates more funding for this bureaucracy than for the Army, Navy, Marines, and Air Force combined.” [Bloomberg News, 2/9/2009] McCaughey’s claims are very similar to the ones she made against the Clinton administration’s attempt to reform health care in 1994 (see Mid-January - February 4, 1994). They will be proven false (see July 23, 2009).
