Journalist Daphne Eviatar writes that during the eight years of the Bush presidency, prosecutions and enforcement of the 1994 Freedom of Access to Clinic Entrances Act (FACE—see May 1994) “cratered,” with Justice Department officials refusing to prosecute or sometimes even investigate complaints of vandalism, harassment, and assault. After the recent murder of abortion provider Dr. George Tiller (see May 31, 2009), Eviatar and the Washington Independent obtained government data showing that enforcement of the FACE law, and other federal laws designed to protect abortion providers and clinics, declined by 75 percent during the Bush presidency. Between 1994 and 1999, when President Clinton was in office, the Justice Department filed 17 complaints under the FACE Act. Between 2001 and 2009, when President Bush was in office, the Justice Department only filed a single case. Tiller’s own clinic was vandalized numerous times, but complaints against the actions were ignored by the department. Statistics provided by the National Abortion Federation (NAF) show that over 3,200 acts of violence against abortion providers in the US and Canada were committed between 2000 and 2008, and the organization says the number of actual incidents was probably “much higher.” The number does not include threats, vandalism, and harassment. NAF statistics show that at least 17 cases of “extreme” violence against abortion providers in the US were reported, including arson, stabbings, bombings, and fake anthrax mailings. But the Bush Justice Department only prosecuted 11 individuals for these attacks. The two highest-profile anti-abortion prosecutions were those of anthrax mailer Clayton Waagner (see 1997-December 2001) and bomber Eric Rudolph (see April 14, 2005). However, none of Waagner’s or Rudolph’s associates in the extremist organization Army of God (see 1982) were ever prosecuted as accessories to the two activists’ crimes. Neither was the Army of God ever investigated as a potential domestic terrorist organization (see Early 1980s). [Washington Independent, 6/12/2009]
Gregg Jarrett, guest host of Fox News’s “straight news” broadcast The Live Desk (see October 13, 2009), tells viewers that the Obama Justice Department “thinks it’s okay to intimidate white people, not okay to intimidate black people at the polls.” Jarrett and others are discussing the Justice Department’s decision to dismiss a case against the New Black Panthers, who had been accused of intimidating white voters during the November 2008 elections. Jarrett interviews Washington Times editor John Solomon, whose paper implied, without proof, that the decision to drop the case may have come from “senior elected or politically appointed” White House officials and not from career prosecutors who felt the case lacked merit, as the Justice Department says. Solomon says that during the Bush administration, Congressional Democrats “very strongly raised questions about the politicization of the Justice Department—political people, or career people answering to political people, overruling the front lines of the Justice Department, and this fits that debate right now in the Justice Department. And I think Congress, the Republicans and some Democrats, are asking questions now about whether career people got their say here and whether they were really listened to, or whether some other agenda had been carried out.” Jarrett then notes: “Well, the other message may be that this is a Department of Justice who thinks it’s okay to intimidate white people, not okay to intimidate black people at the polls. That could be one conclusion that people may reach here by their decision.” [Media Matters, 7/30/2009]
Mary Patrice Brown. [Source: Allgov (.com)]The Justice Department’s Office of Professional Responsibility (OPR) recommends reversing a Bush-era policy and reopening nearly a dozen prisoner abuse investigations, mostly in Iraq and Afghanistan. The decision could potentially expose CIA employees and contractors to prosecution for crimes involving brutalizing and torturing prisoners in US custody, particularly as some detainees died in custody and others were physically and mentally abused. The OPR makes the recommendation in early August, but the information is not reported in the media until later in the month. The decision comes as the Justice Department is ready to disclose new information on prisoner abuse from a 2004 report by the CIA’s inspector general that has never before been released (see May 7, 2004). The Bush-era Justice Department chose not to pursue investigations into any of the allegations, deciding that none of them warranted further inquiry. However, Attorney General Eric Holder reconsidered that decision after he saw the allegations and the accompanying evidence, much of which is contained in the 2004 CIA report. The OPR gives Holder additional leverage to reopen the investigations. The OPR report is primarily authored by the office’s new chief, Mary Patrice Brown, a federal prosecutor picked to replace the office’s former head, H. Marshall Jarrett, who is working elsewhere in the Justice Department. One case under review is that of Iraqi citizen Manadel al-Jamadi, who died in 2003 at Abu Ghraib prison (see Between 4:30 a.m. and 5:30 a.m. November 4, 2003) after being captured by a team of Navy SEALs. Prosecutors believe he received his fatal injuries from his captors, but lawyers for the SEALs deny the charge. During President Bush’s tenure, the Justice Department responded to inquiries about the incidents from Democratic lawmakers with little more than summaries of the numbers of cases under scrutiny, and provided virtually no details about individual cases or explanations as to why the department chose not to prosecute. The CIA, apparently in response to the Justice Department’s release of a 2004 CIA report that documents numerous instances of torture and abuse of detainees in US custody (see August 24, 2009), releases two previously classified agency reports from 2004 and 2005 that purport to prove that the agency’s “enhanced interrogation” program provided information necessary for stopping terrorist attacks. One report calls the program “a crucial pillar of US counterterrorism efforts,” and describes how interrogations helped unravel a network headed by an Indonesian terrorist known as Hambali (see August 12, 2003). The other report details information elicited from alleged 9/11 mastermind Khalid Shaikh Mohammed, saying it “dramatically expanded our universe of knowledge on al-Qaeda’s plots.” [New York Times, 8/24/2009] The two memos state that some detainees, particularly Khalid Shaikh Mohammed, provided useful information during debriefing sessions. One memo, titled “Detainee Reporting Pivotal for the War against Al-Qa’ida,” says that intelligence gathered from multiple detainees, combined with other information, led to the capture of several key al-Qaeda operatives, and aided in the capture of Tawfiq bin Attash (see April 29 - Mid-May, 2003), who “was captured on the verge of mounting attacks against the US consulate in Karachi, Westerners at the Karachi Airport, and Western housing areas” in Pakistan. Another report says that Mohammed “has provided information on al-Qaeda strategic doctrine, probable targets, the impact of striking each target set, and likely methods of attacks inside the United States.” They do not, however, say that Mohammed or other detainees provided useful information as a direct result of being tortured. Cheney Claims Memos Prove Efficacy of Torture - The memos have been touted by former Vice President Dick Cheney as proving the efficacy of “enhanced interrogation techniques”—torture—in gaining actionable intelligence from detainees. Cheney has repeatedly asked for the memos to be declassified so as to prove his contention. In the wake of the memos’ release, Cheney claims that the memos do indeed prove that torture worked. “The documents released Monday,” Cheney says in a statement, “clearly demonstrate that the individuals subjected to enhanced interrogation techniques provided the bulk of intelligence we gained about al-Qaeda” (see August 24, 2009). [Weekly Standard, 8/24/2009] However, the New York Times notes that the memos “do not refer to any specific interrogation methods and do not assess their effectiveness.” [New York Times, 8/24/2009]
CIA Director: Memos 'Old News' - CIA Director Leon Panetta sends a message to agency employees concerning the release of the two memos, calling their contents “in many ways an old story,” and says that “the challenge is not the battles of yesterday, but those of today and tomorrow. My emphasis on the future comes with a clear recognition that our agency takes seriously proper accountability for the past.… As the intelligence service of a democracy, that’s an important part of who we are.” [Washington Post, 8/24/2009]

[Source: CIA / New York Times]A 2004 report by the CIA’s inspector general (IG) on torture (see May 7, 2004) is released to the public, after months of speculation as to its contents. The CIA opposed the release of the report for years, arguing that the release would demoralize its personnel and make it more difficult for the agency to do its job. The report’s release is triggered by a federal judge’s ruling in response to a lawsuit filed by the American Civil Liberties Union (ACLU). The report, authored by former Inspector General John Helgerson, is heavily redacted, but the portions released to the public include a number of illegal and ethically questionable tactics used by US interrogators against detainees. Some of those tactics include the use of handguns, power drills, threats, smoke, and mock executions. Many of the techniques used against detainees were carried out without authorization from higher officials, and the Justice Department is reopening investigations into a number of the most serious allegations (see First Half of August 2009). The report says that the CIA’s efforts to provide “systematic, clear, and timely guidance” to interrogators were “inadequate at first” and that that failure largely coincided with the most significant incidents involving the unauthorized coercion of detainees, but as guidelines from the Justice Department accumulated over several years, oversight “improved considerably.” In the words of the Washington Post, “the report pointed to ongoing tensions between interrogators in the field and officials at the CIA Counterterrorism Center as to when detainees were compliant and when the use of ‘enhanced interrogation techniques’ was appropriate.” [MSNBC, 8/24/2009; Washington Post, 8/24/2009] In a statement, Helgerson says, “The most important findings of the review related to basic systemic issues: had management controls been established; were necessary laws, regulations, and guidelines in place and understood; had staff officers and contractors been adequately trained; and had they discharged their responsibilities properly?” [Washington Post, 8/24/2009] Newsweek reporter Michael Isikoff says that the “report was generated at the beginning by agency officials within themselves who had deep concerns about what was going on. I was struck. One officer is quoted in this report saying that he’s concerned that he might one day—agency officers might one day end up on some ‘wanted list’ to appear before the world court for war crimes stemming from these activities. It was agents—it was the concerns about this came from within the agency. That’s what generated this report.”
Recommendations Redacted - Isikoff notes that at least half of the report is redacted, including the IG’s recommendations, and says, “I’m told the worst stuff is in those blacked out passages, which means we still don’t know the full story of this program.” [MSNBC, 8/25/2009] The report contains 10 recommendations for action on the CIA’s part, but all of them are redacted. [McClatchy, 8/24/2009] Helgerson states his regret that so much of the report is redacted. “The essence of the report is expressed in the Conclusions and Recommendations,” he says. “I am disappointed that the government did not release even a redacted version of the Recommendations, which described a number of corrective actions that needed to be taken.” [Washington Post, 8/24/2009] Isikoff’s Newsweek colleague, Mark Hosenball, says he believes much of the redacted information has to do with “renditions”: detainees transferred to foreign countries “and abused there.” [PBS, 8/24/2009]
Detailing 'Crime Scene[s]' - Author and reporter Jane Mayer says she believes the report, “in essence, [details] a crime scene. It’s very hard to get away from the fact that things like death threats and mock executions are specifically identified as torture under the Convention Against Torture and, therefore, are illegal, and they’re considered very major crimes. So the problem for the Obama administration, which inherited this report and the question about what to do about it, is that it’s a red flag to any prosecutor. It’s very hard to ignore this, when you’ve taken an oath of office that says you’re going to execute the laws and uphold the Constitution. So they’ve got to somehow do something with this. I was interviewing Larry [Laurence] Tribe, a law professor, who said, you know, it’s hard to do nothing about this when you see it.” Reporter David Ignatius notes that an earlier review by Justice Department prosecutors found that no one at the CIA could be prosecuted for crimes based on the findings of the report. However, that may no longer be true. “[I]t is interesting and troubling to people at the CIA that something that was already decided not prosecutable is now maybe prosecutable,” he says. Mayer notes that during the Bush administration, possible prosecutions were short-circuited by political appointees such as then-US Attorney Paul McNulty, “who was very much a political player, who actually wound up having to resign later in the Bush administration for other political problems.” [PBS, 8/24/2009]
Federal Prosecutor Appointed - In part as a result of reviewing the CIA report, Attorney General Eric Holder names a special prosecutor to determine if the CIA or its hired contractors broke any laws in interrogating detainees (see August 24, 2009).
Reactions - CIA Director Leon Panetta issues a statement that supports the agency’s efforts while avoiding defending torture or abuse. In his statement, Panetta writes that he is not “eager to enter the debate, already politicized, over the ultimate utility of the agency’s past detention and interrogation effort.” He says the program produced crucial intelligence but adds that use of the harsh methods “will remain a legitimate area of dispute.” Overall, Panetta says, the agency is committed to “moving forward” and not spending large amounts of time reflecting on past practices. Senator Sheldon Whitehouse (D-RI) calls the report, and the concurrent appointment of special prosecutor John Durham to investigate torture allegations (see August 24, 2009), “a great relief, a great moment for America as a country.” He continues: “We’ve finally seen the rule of law brought forward in a way that it is clear and direct on this situation, which has been so sort of poisoned with personalities and politics and propaganda. It’s a first kind of clear, bright light, and I couldn’t be happier, couldn’t be more relieved.” [New York Times, 8/24/2009; Central Intelligence Agency, 8/24/2009; MSNBC, 8/25/2009] The ACLU’s Jameel Jaffer says, “The report underscores the need for a comprehensive criminal investigation that reaches not just the interrogators who exceeded authority but the senior officials who authorized torture and the Justice Department lawyers who facilitated it.” [Washington Post, 8/24/2009] Joanne Mariner, the terrorism and counterterrorism program director at Human Rights Watch, says: “The CIA inspector general’s report provides compelling official confirmation that the CIA committed serious crimes. A full criminal investigation into these crimes, and who authorized them, is absolutely necessary.” [Human Rights Watch, 8/24/2009]

Attorney General Eric Holder announces he has appointed a federal prosecutor from Connecticut, John Durham, as a special prosecutor to investigate whether CIA interrogators broke any federal laws. [US Department of Justice, 8/24/2009; Washington Post, 8/25/2009]
Decision Stems from CIA IG Report - The investigation is preliminary in nature, and will decide whether a full investigation is warranted. Holder bases his decision in part on a just-released 2004 report on torture by the CIA’s inspector general (see August 24, 2009) and a Justice Department recommendation that there should be an investigation of about a dozen cases of possible abuse and torture from Iraq and Afghanistan (see First Half of August 2009). According to the conclusion of the CIA report: “The enhanced interrogation techniques used by the agency under the CTC [Counterterrorist Center] program are inconsistent with the public policy positions that the United States has taken regarding human rights. Unauthorized, improvised, inhumane, and undocumented detention and interrogation techniques were used.” [New York Times, 8/24/2009; MSNBC, 8/25/2009] The review is also prompted by a report by the Justice Department’s Office of Professional Responsibility (OPR) into memoranda drafted by the department’s Office of Legal Counsel related to “enhanced interrogation techniques.” The OPR report recommends the department re-examine previous decisions not to prosecute in some cases related to the interrogation of certain detainees. The aim of the preliminary review is to find whether federal offenses were committed in some detainee interrogations. [US Department of Justice, 8/24/2009] According to the Washington Post, the review will focus on “a very small number of cases,” including one in which a CIA officer named Zirbel caused Afghan prisoner Gul Rahman to freeze to death at the Salt Pit prison in Afghanistan (see November 20, 2002) and the intimidation of al-Qaeda leader Abd al-Rahim al-Nashiri by a CIA officer named “Albert” using a handgun and drill (see Between December 28, 2002 and January 1, 2003). These cases and the others were previously referred by the CIA inspector general to the Justice Department for examination, but the department decided not to prosecute (see (August 2004) and Mid-October 2005). Durham a Veteran Prosecutor - Durham has been investigating the CIA’s destruction of videotapes of interrogations that may have documented instances of torture (see January 2, 2008). Although Durham has a low public profile, he is a veteran of numerous high-level prosecutions, including cases against Boston-area organized crime figures, corrupt FBI agents, and former Governor John Rowland (R-CT). Durham is considered apolitical, and has worked closely with the Justice Department under both Democratic and Republican administrations. Connecticut defense lawyer Hugh Keefe calls him “the go-to guy for Justice whenever they get a hot case.” Former Connecticut prosecutor Mark Califano calls Durham’s approach to investigations “clinical,” and says he has “very rarely” concluded a case without bringing criminal charges. “He likes to make cases when there is evidence there,” Califano says. “You’ve got to balance whether that kind of information exists.… You can’t move forward if you don’t have the evidence.” [US Department of Justice, 8/24/2009; MSNBC, 8/25/2009; Washington Post, 8/25/2009] Boston prosecutors and defense attorneys have characterized Durham as “honest” and “tenacious.” Warren Bamford, who heads Boston’s FBI office, said Durham “kind of has blinders on in the sense that he doesn’t worry about the politics and all the other stuff that might be swirling around, and I think that’s really what makes him so successful.” [Boston Globe, 1/7/2008] In a statement, Holder says, “Mr. Durham, who is a career prosecutor with the Department of Justice and who has assembled a strong investigative team of experienced professionals, will recommend to me whether there is sufficient predication for a full investigation into whether the law was violated in connection with the interrogation of certain detainees.” [Think Progress, 8/24/2009]
Senator: Durham a 'First-Rate' Choice - Senator Sheldon Whitehouse (D-RI) is enthusiastic about the choice of Durham. He says he has worked with Durham before, while Whitehouse was US Attorney for Rhode Island, and calls the prosecutor “very professional” and “a first-rate choice,” adding that Durham has “a very good grounding in this because he has been doing the investigation into the destruction of the torture tapes.” [MSNBC, 8/25/2009]
No Acknowledged 'Break' with White House - Holder notes that he will be criticized for undermining the CIA, and may be going against abjurations by President Obama to “move forward” instead of focusing on past transgressions, but says the facts left him little choice. “As attorney general, my duty is to examine the facts and to follow the law,” he says in a statement. “Given all of the information currently available, it is clear to me that this review is the only responsible course of action for me to take.… I have concluded that the information known to me warrants opening a preliminary review into whether federal laws were violated in connection with the interrogation of specific detainees at overseas locations.” White House officials say Holder’s decision does not mark a break between the White House and the Justice Department on their policies toward interrogations. Deputy press secretary Bill Burton tells reporters that “ultimately, the decisions on who is investigated and who is prosecuted are up to the attorney general.… The president thinks that Eric Holder, who he appointed as a very independent attorney general, should make those decisions.” [New York Times, 8/24/2009; Washington Post, 8/24/2009; MSNBC, 8/25/2009] Justice Department spokespersons refuse to say who will, and who will not, be investigated. The response by media and public officials to the announcement of a preliminary investigation by the Justice Department into whether crimes were committed in the course of a small number of detention and interrogation cases by the CIA (see August 24, 2009) is mixed. The investigation is headed by special prosecutor John Durham. Reporter Michael Isikoff says that it will be “difficult to bring cases against agency operatives when you have the [former] attorney general of the United States [John Ashcroft] saying repetitive use of waterboarding is okay with him. He has no problem with it. The Justice Department has no problem with it—which is why some people say if we’re not going to have criminal investigations at the very top, the leadership that authorized these programs, at least have full disclosure so the American public can know the full story of what happened.” Senator Ron Wyden (D-OR) criticizes the potential focus on interrogators and says the inquiry should focus on former Bush administration officials and Justice Department lawyers; he says the investigation could echo the Abu Ghraib investigation, where “lower ranking troops who committed abuses were hung out to dry.” Representative Peter Hoekstra (R-MI), the ranking Republican on the House Intelligence Committee, says the Justice Department inquiry risks disrupting current counterterrorism operations, and claims that abuse charges have already been “exhaustively reviewed.” [New York Times, 8/24/2009; MSNBC, 8/25/2009]
Lack of Accountability? - Joanne Mariner, the terrorism and counterterrorism program director at Human Rights Watch, says: “It’s heartening that the attorney general has opened a preliminary investigation of these crimes, but it’s crucial that its scope include senior officials who authorized torture. Lower-level CIA operatives—even if using so-called ‘unauthorized’ techniques—may still have relied on the letter or the spirit of high-level authorizations.” Human Rights Watch warns that if the investigation focuses solely on so-called “rogue” interrogators who acted without official authorization, but fails to investigate senior officials with responsibility for the interrogation program, it will lack credibility. The organization writes, “Such an approach would validate the Bush-era Justice Department memoranda that authorized torture.” It calls the US’s record on accountability for detainee abuse “abysmal.” [Human Rights Watch, 8/24/2009]
Focusing on 'Low-Level Operatives'? - The American Civil Liberties Union’s Jameel Jaffer later says that Durham’s investigation seems to be far too narrow in scope, focusing solely on CIA interrogators and ignoring Bush administration officials who authorized torture and other abusive actions. [TPM Muckraker, 8/31/2009] This position is echoed by the Center for Constitutional Rights, which states: “Responsibility for the torture program cannot be laid at the feet of a few low-level operatives. Some agents in the field may have gone further than the limits so ghoulishly laid out by the lawyers who twisted the law to create legal cover for the program, but it is the lawyers and the officials who oversaw and approved the program who must be investigated.” The center demands the appointment of “an independent special prosecutor with a full mandate to investigate those responsible for torture and war crimes, especially the high ranking officials who designed, justified, and orchestrated the torture program.” Another organization, Physicians for Human Rights, says that it “urges the administration to pursue any investigation up the chain of command to those officials who authorized and supervised the use of illegal techniques.” [TPM Muckraker, 8/24/2009] Several Democrats, including Senators Russ Feingold (D-WI) and Judiciary Committee chair Patrick Leahy (D-VT), and two members of the House Judiciary Committee, Jerrold Nadler (D-NY) and John Conyers (D-MI), issue statements urging the investigation to go beyond looking into the actions of CIA interrogators, and investigate the officials who authorized those actions. The Department of Justice agrees to pay the legal fees of Sabrina De Sousa, a former CIA officer on trial in absentia in Italy over the kidnapping of Islamist extremist Hassan Mustafa Osama Nasr (a.k.a. Abu Omar—see Noon February 17, 2003). However, the decision comes shortly before the verdict in the trial is to be announced. De Sousa will comment: “Unbelievable! The United States Department of Justice just ‘approved’ an attorney to defend me, a month after the trial ended, knowing full well that an attorney at this stage will make little or no difference to the outcome or verdict.” Although DeSousa has been suing the government over the expenses since May (see May 13, 2009), the move appears to be related to a general decision by CIA Director Leon Panetta to pay the legal costs of officers caught up in investigations of post-9/11 CIA programs. However, it is unclear whether the other 24 CIA defendants in the case are having their expenses paid, although the 26th US defendant, an Air Force officer, is. De Sousa denies involvement in the rendition, but will not comment on her employment by the CIA. “I had hoped that the Obama leadership in the Departments of Justice and State would step in to do the right thing and ensure I was provided the immunity to which I was entitled rather than sacrifice me to protect the high-level officials who presumably sanctioned the incident,” she adds. “This sends a terrible message to those in our military and diplomatic corps who risk their lives overseas to protect the interests of our country.” [Congressional Quarterly, 8/28/2009]
Seven former directors of the CIA urge President Obama to end the investigation of claims that the CIA tortured detainees to obtain intelligence (see August 24, 2009). The investigation was triggered by the release of an internal CIA report from 2004 (see August 24, 2009). The directors say that all the cases in the 2004 report have already been adequately investigated, and to reopen those investigations would make it difficult for intelligence agents to believe they can safely follow legal guidance. In a letter signed by the seven former directors, they write: “Attorney General Holder’s decision to re-open the criminal investigation creates an atmosphere of continuous jeopardy for those whose cases the Department of Justice had previously declined to prosecute. Those men and women who undertake difficult intelligence assignments in the aftermath of an attack such as September 11 must believe there is permanence in the legal rules that govern their actions.… [T]his approach will seriously damage the willingness of many other intelligence officers to take risks to protect the country.” The letter is signed by former CIA directors Michael Hayden, Porter Goss, George Tenet, John Deutch, James Woolsey, William Webster, and James Schlesinger. Current CIA Director Leon Panetta opposed the investigation, but says that he will cooperate with it (see Before August 24, 2009). [Fox News, 9/18/2009]
ACLU: Letter 'Self-Serving' and Wrong - The American Civil Liberties Union’s Jameel Jaffer calls the letter “self-serving,” writing: “Attorney General Holder initiated a criminal investigation because the available evidence shows that prisoners were abused and tortured in CIA custody. The suggestion that President Obama should order Attorney General Holder to abort the investigation betrays a misunderstanding of the role of the attorney general as well as the relationship between the attorney general and the president. Where there is evidence of criminal conduct, the attorney general has not just the authority but the duty to investigate. The attorney general is the people’s lawyer, not the president’s lawyer, and it would be profoundly inappropriate for President Obama to interfere with his work. The attorney general’s investigation should be allowed to proceed without interference, and it certainly should not be derailed by the self-serving protests of former CIA officials who oversaw the very crimes that are being investigated. If there is a problem with the unfolding criminal investigation, it is that its focus is too narrow. There is abundant evidence that torture was authorized at the highest levels of the Bush administration, and the Justice Department’s investigation should be broad enough to encompass Bush administration lawyers and senior officials—including the CIA officials—who authorized torture.” [TPM Muckraker, 9/18/2009]
Justice Department Responds - The Justice Department counters the letter with its own statement: “The attorney general works closely with the men and the women of intelligence community to keep the American people safe and he does not believe their commitment to conduct that important work will waver in any way. Given the recommendation from the Office of Professional Responsibility as well as other available information, he believed the appropriate course of action was to ask John Durham to conduct a preliminary review. That review will be narrowly focused and will be conducted by a career prosecutor who has shown an ability to handle cases involving classified information. Durham has not been appointed as a special prosecutor; he will be supervised by senior managers at the [Justice] Department. The attorney general’s decision to order a preliminary review into this matter was made in line with his duty to examine the facts and to follow the law. As he has made clear, the Department of Justice will not prosecute anyone who acted in good faith and within the scope of the legal guidance given by the Office of Legal Counsel regarding the interrogation of detainees.” [Washington Independent, 9/18/2009]

Law professor Benjamin Davis calls on former Bush administration officials to step forward and cooperate with the Justice Department investigation into torture, being led by prosecutor John Durham (see August 24, 2009). Davis makes his call after attending a debate called “After Guantanamo” at Case Western Reserve Law School. During that debate, he writes, “members of the former administration regaled the audience with stories about the mistakes made and the arrogance demonstrated by persons with whom they had worked on the issues of detention, interrogation, and military commissions.” Davis writes that “it would seem preferable for the former administration members to tell their stories to the federal prosecutor rather than to audiences at conferences.” He calls the stories “appalling,” citing incidents of “arrogant disdain for military lawyers” displayed by senior Bush officials, widespread ignorance of military law, “and the general indifference of those tasked with developing detention, interrogation, and military commission policy in the prior administration.” Davis calls on the former adminstration officials to go farther than they did at Case Western: “Names were not named in the conference, but names should be named to John Durham. He is permitted to ‘follow the facts wherever they lead,’ but if those lawyers, other civilians, and uniformed types who know where the dogs are buried refrain from coming forward, they will make the task more arduous than it needs to be. Everyone who has a story is a witness in piecing together what really went on. Every lawyer has also sworn an oath to be an officer of the court and is under an ethical duty to refrain from abetting crimes. Help John Durham find the facts.” He concludes by asking: “[B]eyond legal or ethical obligations, the real question is of what these architects of detention, interrogation, and military commission policy are made of. Are they made of the stuff that led Specialist Darby [Joseph Darby—see January 13, 2004] to clearly see what was wrong with detainee treatment in Abu Ghraib, thus prompting him to provide military investigators with the incriminating photos? Or are these persons made of the stuff of cowards that hope this will all go away if they do not say anything to anyone—posturing in public and cowering in private?” [Jurist, 9/18/2009]
Federal judge Emmet Sullivan rules that the FBI must publicly reveal information from its 2004 interview with then-Vice President Dick Cheney during the Valerie Plame Wilson leak investigation (see May 8, 2004). The information has been kept classified by both the Bush and Obama administrations, who have argued that future presidents, vice presidents, and their senior staff may not cooperate with criminal investigations if they know what they say could became public. Sullivan rules that there is no justification to withhold the FBI records of Cheney’s interview, since the leak investigation has long since concluded. Further, the idea that such a judgment may lead to future reluctance to cooperate with investigations is ‘incurably speculative’ and cannot affect his judgment. To rule in favor of the Bush and Obama administrations, Sullivan says, would be “breathtakingly broad” and “be in direct contravention of ‘the basic policy’ of” the Freedom of Information Act. He does allow some portions, affecting national security and private communications between Cheney and former President Bush, to be redacted. Those portions include details about Cheney’s talks with then-CIA Director George Tenet about Joseph Wilson’s trip to Niger (see February 21, 2002-March 4, 2002), talks with then-National Security Adviser Condoleezza Rice, discussions about Bush’s 2003 State of the Union address (see Mid-January 2003 and 9:01 pm January 28, 2003), discussions about how to respond to press inquiries about the leak of Plame Wilson’s identity, and Cheney’s involvement in declassification discussions. The Justice Department has previously indicated that it would appeal any ruling allowing the information of Cheney’s testimony to be made public. The declassification was sparked by a July 2008 lawsuit filed by the watchdog organization Citizens for Responsibility and Ethics in Washington (CREW), who filed a Freedom of Information Act request with the Justice Department seeking records related to Cheney’s interview in the investigation. In August, CREW sued for the records. CREW’s Melanie Sloan says the group hopes the Obama administration will reveal the entire record in the interest of transparency. “The American people deserve to know the truth about the role the vice president played in exposing Mrs. Wilson’s covert identity,” she says. “High-level government officials should not be permitted to hide their misconduct from public view.” [Associated Press, 10/1/2009; Politico, 10/1/2009]

[Source: Associated Press]In November 2009, Virginia “Ginni” Thomas, a former Republican campaign operative and the wife of Supreme Court Justice Clarence Thomas, establishes a new “tea party” organization she calls Liberty Central. (Some media sources claim that Liberty Central begins operations in January 2010.) She describes the group as intended to bridge the gap between the conservative Republican establishment and the anti-government tea party movement. “I am an ordinary citizen from Omaha, Nebraska, who just may have the chance to preserve liberty along with you and other people like you,” she says at a Conservative Political Action Conference (CPAC) discussion with tea party leaders in Washington. “I adore all the new citizen patriots who are rising up across this country. I have felt called to the front lines with you, with my fellow citizens, to preserve what made America great.” She also says she started the group because of her reaction to what she calls President Obama’s “hard-left agenda.” The group also intends to work to elect Republicans and defeat Democrats, and provide political strategies and “talking points” for conservative candidates. [Los Angeles Times, 3/14/2010; Commission, 7/1/2010; Politico, 7/6/2010; Politico, 2/4/2011] In May 2010, the organization officially declares itself open for business, launching a $27,000 Web site, and touting partnerships with a number of prominent conservative groups and the backing of prominent conservatives such as former Defense Secretary Donald Rumsfeld and Federalist Society executive Leonard Leo, whom Justice Thomas has called “my good friend.” [Politico, 7/6/2010]
Questions of Conflict of Interest, Ethics - Almost immediately, legal ethicists assert that Virginia Thomas’s role as the head of a partisan, openly political advocacy organization could taint her husband’s impartiality, especially in light of the Citizens United Court decision, in which her husband sided with the 5-4 majority (see January 21, 2010), that allows her group to accept donations and spend them without publicly disclosing information about them. The group could have benefited from the Court’s decision, and Justice Thomas’s decision could be seen as being influenced by his wife’s decision to start the group. Law school professor Lucas A. “Scot” Powe, a Court historian, says, “I think the American public expects the justices to be out of politics.” The expectations for spouses are not so clear, he adds, saying, “I really don’t know because we’ve never seen it.” Legal ethicist Stephen Gillers, another law professor, says, “We expect the justice to make decisions uninfluenced by the political or legal preferences of his or her spouse.” Moreover, the press learns that while the Court was deliberating the Citizens United case, Liberty Central received an anonymous $550,000 donation. Government watchdog organization Common Cause wrote a letter to the Justice Department asking if Justice Thomas should recuse himself from the case, and wrote that “the complete lack of transparency of Liberty Central’s finances makes it difficult to assess the full scope of the ethics issues raised by Ms. Thomas’s role in founding and leading the group.” (The media later learns that $500,000 of the anonymous $550,000 donation for the organization comes from Dallas real estate investor Harlan Crow, who also hosts a fundraising event for the organization at his home. Crow once gave Justice Thomas a $19,000 “Frederick Douglass Bible” as a gift, and donated $150,000 to build a new wing named for Justice Thomas on a Savannah, Georgia, library that he visited frequently in his youth.) Common Cause also notes that Justice Thomas had failed to report on his financial disclosure filings his wife’s income over the last 13 years, prompting him to file amendments to the filings that indicated the sources, but not the amounts, of his wife’s income. Justice Thomas refuses to recuse himself from the case.
Period of Success - Liberty Central flourishes for a brief time, with Virginia Thomas assembling a veteran staff and forging relationships with conservative donors, with most of whom she and her husband had long, close relationships. Carl Graham of the Montana Policy Institute, one of the over 30 state and national tea party groups that are listed as partners in Liberty Central’s affiliate network, says, “Her association with Justice Thomas clearly provides a level of credibility that others wouldn’t be able to have, just because of the beliefs that he has and the stands that he has on the different positions that align with our own.” Liberty Central’s connection with Justice Thomas, Graham says, “gets you to open the email, if nothing else, as opposed to some other one that you may not even open.” Liberty Central hires the services of CRC Public Relations, a prominent Washington communications firm that has garnered some $15 million in fees from a number of clients, including top Republican Party committees and the presidential campaigns or political committees of George W. Bush, Mitt Romney, and John McCain, among others. Matt Kibbe of FreedomWorks, a tea party lobbying organization also partnered with Liberty Central (see April 14, 2009 and April 15, 2009), says, “Ginni was able to raise the seed capital to have a real launch” because of her connections in small-government conservative circles. Kibbe says most people are unaware that she is the wife of a Supreme Court justice. Tea Party Patriots leader Jenny Beth Martin calls Thomas a “mentor” for many tea party organizations, and says she helps these organizations “to navigate some of the waters in DC.… She’s been kind of a mentor, and when we had questions about things that we were doing, we bounced a few of the ideas off of her and also off of a few other people in DC just to make sure that what we were doing made sense.” [Los Angeles Times, 3/14/2010; Politico, 7/6/2010; Politico, 2/4/2011]
Media Attention - In a June 2010 interview with Fox News host Sean Hannity, Thomas says she is sure “liberals” will “persecute” her just as she says they did when her husband was undergoing confirmation for the Supreme Court. “They’re after me now sometimes,” she says. “And so, we’re not going to be dissuaded. We are in the fight for our country’s life.” She and Hannity engage in a lively conversation about the “tyranny” of the Obama administration. She also promises to “watch for conflicts” between herself and her husband. In October 2010, the media reports that Virginia Thomas leaves a voice mail for former college professor Anita Hill, who accused her husband of sexual harassment during his confirmation hearings for the Court (see October 8, 1991, October 8-12, 1991, and October 11-12, 1991), demanding that Hill issue an apology to her husband. The voice mail says: “Good morning, Anita Hill, it’s Ginni Thomas. I just want to reach across the airwaves and the years and ask you to consider something. I would love you to consider an apology sometimes and some full explanation of why you did what you did with my husband. So give it some thought and certainly pray about this and come to understand why you did what you did. Okay, have a good day.” The attention from the voice mail prompts more negative media attention, and some donors begin distancing themselves from the organization. (Virginia Thomas later admits that her voice mail message for Hill was “probably a mistake,” though she will call the media’s response to it “laughable.” She will call the message “an olive branch” she extends to Hill. For her part, Hill says: “I don’t apologize. Thomas Steps Down, Group Merges with Another Organization - In November 2010, Virginia Thomas steps down from her leadership post at Liberty Central. The group then merges with another, similar group called the Patrick Henry Center for Individual Liberty, an organization founded by ex-CIA agent Gary Aldrich, who wrote a largely discredited book “exposing” the “secrets” of the Clinton administration. Sources later tell reporters that Virginia Thomas sells off Liberty Central because it cannot raise the funds needed to support its large staff and high overhead. According to CRC spokeswoman Caitlin Carroll, Thomas will “take a back seat so that Liberty Central can continue with its mission without any of the distractions. After discussing it with the board, Mrs. Thomas determined that it was best for the organization.” However, Sarah E. Field, general counsel of Liberty Central, disagrees, saying: “There are many opportunities being presented to Liberty Central, but there is no agreement at this time.… The sources of this story appear to be people without full understanding of the facts.” Keith Appell of CRC tells a reporter that the Washington Post’s Amy Gardner “breached confidentiality” by reporting her conversation with Carroll. Gardner responds, “Everything I attributed to Caitlin Carroll comes from an on-the-record conversation we had by telephone this morning.” Within hours, Thomas files incorporation papers for a new political lobbying and consulting firm, Liberty Consulting (see February 4, 2011). The US Justice and Defense Departments announce that five detainees are to be moved from Guantanamo to New York, where they will face trial in ordinary civilian courts for the 9/11 attacks. The five are alleged 9/11 mastermind Khalid Shaikh Mohammed (KSM), Ramzi bin al-Shibh, who helped coordinate the attacks, Ali Abdul Aziz Ali and Mustafa Ahmed al-Hawsawi, who assisted some of the 19 hijackers in Asia, and Khallad bin Attash, who attended a meeting with two of the hijackers in January 2000 (see January 5-8, 2000). The five previously indicated they intend to plead guilty (see December 8, 2008). US Attorney General Eric Holder says: “For over 200 years, our nation has relied on a faithful adherence to the rule of law to bring criminals to justice and provide accountability to victims. Once again we will ask our legal system to rise to that challenge, and I am confident it will answer the call with fairness and justice.” Secretary of Defense Robert Gates was also involved in the decision on where to try the men. A lawyer acting for Ali Abdul Aziz Ali, one of a five high-profile defendants to be tried in New York for 9/11, says that his client and the others intend to plead not guilty. The lawyer, Scott Fenstermaker, says they will do so not in the hope of an acquittal, but to air their criticism of US foreign policy. While incarcerated at Guantanamo, the five had intended to plead guilty before a military commission (see December 8, 2008). According to Fenstermaker, the men will admit carrying out 9/11, but intend to formally plead not guilty so they can “explain what happened and why they did it.” They will give “their assessment of American foreign policy,” which is “negative.” Fenstermaker recently met with his client, but has not met with the other four defendants, although he says the five have discussed the issue among themselves. In response, Justice Department spokesman Dean Boyd says that while the men may attempt to use the trial to express their views, “we have full confidence in the ability of the courts and in particular the federal judge who may preside over the trial to ensure that the proceeding is conducted appropriately and with minimal disruption, as federal courts have done in the past.” [Associated Press, 11/22/2009]
The US Department of Justice’s Office of Professional Responsibility refuses to refer two former Bush administration officials to authorities for criminal or civil charges regarding their authorizations of the torture of suspected terrorists (see Before April 22, 2009). John C. Yoo and Jay S. Bybee, two senior officials in the DOJ’s Office of Legal Counsel, provided the legal groundwork that allowed American interrogators to use sleep deprivation, waterboarding, and other torture methods against terror suspects (see Late September 2001, January 9, 2002, and August 1, 2002). The report finds that Yoo and Bybee, along with former OLC head Steven Bradbury, exhibited “poor judgment” in their actions. The OPR refuses to make the report’s conclusions public. It is known that senior Justice Department official David Margolis made the decision not to refer Yoo and Bybee for legal sanctions. Delaware Republican Party chairman Tom Ross receives a death threat over his support for incumbent Mike Castle (R-DE) in the upcoming Delaware Senate primaries. Castle, a House member widely considered to be a moderate Republican (see June 30, 2009), is opposed by Christine O’Donnell, a hard-right Republican who has received the support of several area “tea party” organizations. Ross receives an email telling him that he deserves “a bullet in the head” for backing “political _ss-kissing RINO’s” [Republicans in name only]. The email continues: “It is one thing to have your country screwed over by socialists, it is far worse to be backstabbed by people pretending to be your friends. We will either rid the GOP of pieces of sh_t like you, or we will start a new ‘Common Sense Conservative’ party and render you all useless.” Ross leaves his home temporarily in fear for his life, and the US Department of Justice mounts an investigation. The email contains the name and address of the sender, though that information will not be made public. “It is just scary what is going on right now,” says a Delaware Republican Party official. “Tom is a loyal and dedicated Republican officer in Delaware… the position is unpaid and his job as party chairman is to defend and promote the candidates.… It is disgusting, it is amazing, and it has no place in our democracy.” In a statement, O’Donnell’s campaign condemns the threat, saying, “We hope Mr. Ross and his family are safe, as no one should have to go through personal attacks like this.” Reporter Sam Stein concludes: “Coming at the end of an emotional and hard-fought campaign, it’s difficult to gauge both the purpose and the fallout of the death threat. If confirmed as both serious and sincere, it provides yet another piece of evidence that recently politics has veered into something more troubling than previously seen. O’Donnell supporters, undoubtedly, will be skeptical of the story’s emergence at this late stage of the primary fight, noting that Castle is the primary beneficiary if her candidacy is seen as inspiring political intolerance, if not downright violence.” [Huffington Post, 9/13/2010; Politico, 9/14/2010] Ross has been highly critical of O’Donnell’s campaign, stating that Delaware voters “are laughing” at her (see November 15, 2007), and has said that if she wins the primary, she is almost certain to lose against her Democratic opponent, county executive Chris Coons, in the November elections. Tea Party Express chairwoman Amy Kremer, of Sacramento, California, says of Ross’s criticisms: “Can you imagine the mess Tom Ross will have created when he is Delaware Republican Party chairman on Tuesday night when Christine O’Donnell becomes the Republican nominee for US Senate? It’s unacceptable, and Tom Ross must quit or be fired immediately. He is a walking disaster.” Current polls show Castle and O’Donnell in a statistical dead heat. O’Donnell has the support of several right-wing conservative groups, including the Senate Conservatives Fund, a group founded by Senator Jim DeMint (R-SC). Governor Rick Scott (R-FL) withdraws a request to have the federal government approve two new Florida redistricting amendments. Under the Voting Rights Act (VRA—see August 6, 1965 and June 29, 1989), the Justice Department (DOJ) must approve any redistricting changes made by Florida to make sure they do not diminish minority voting access. Amendments 5 and 6 were approved by 63 percent of Florida voters in November 2010, the same election that awarded Scott the governorship. The amendments impose new standards for legislators to follow for redistricting in 2012. Then-acting Secretary of State Dawn Roberts submitted the new standards to the DOJ for approval. Scott does not explain his withdrawal, but media reports speculate that he is working with Florida Republicans, who have challenged the new amendments in court. Scott replaced Roberts with former Secretary of State Kurt Browning, the head of Protect Your Vote, an organization which led the opposition to Amendments 5 and 6. Scott only says: “One of the things that we’re looking at is the amendments that were passed, how they’re going to be implemented. We want to make sure that with regard to redistricting, it’s fair, it’s the right way of doing it. So it’s something I’m clearly focused on.” Of Browning, he says, “My agents will do everything we can to make sure it’s fairly done.” The Florida Department of State denies any involvement by Browning in the decision to withdraw the request. Scott’s spokesman Brian Hughes says, “This withdrawal in no way impedes the process of redrawing Florida’s legislative and Congressional districts.” Florida Democrats say Scott is attempting to delay or block implementation of the amendments. Fair Districts Now, the organization that proposed the amendments, issues a statement accusing Scott of trying to subvert the will of the people. It says: “Within its first days in power, the new administration of Governor Rick Scott, through its Department of State, took extraordinary steps to thwart the will of the overwhelming majority of Florida voters who voted for redistricting reform in Florida. On, November 2, 63 percent of Florida voters amended the Florida Constitution to include new non-partisan redistricting standards. When new laws affect voting as these do, the Voting Rights Act requires that the standards be reviewed and ‘pre-cleared’ by the Justice Department (DOJ). It is the duty of the state to request DOJ pre-clearance. Governor Crist ordered that a formal request for pre-clearance be filed. The Florida secretary of state’s office filed that request on December 10, 2010. On January 7, 2011, as one of its first acts, the new administration of Governor Rick Scott, through its Department of State, in an apparent attempt to thwart the will of the voters, wrote to DOJ withdrawing the amendments from review.” Fair Districts Now may sue Florida to have the new standards reviewed by the DOJ. Senate Democratic Leader Nan Rich says Scott should follow the “will of the voters,” and adds: “The governor got elected with 48 percent and he calls that a mandate. I think that the amendment passing with 63 percent is definitely a mandate.” NAACP board member Leon Russell, who supports the two amendments, says Scott is abusing his power “to prevent implementation of these needed reforms.” Regardless of what is and is not done, the redistricting plans will have to receive “pre-clearance” under the VRA before being implemented. Scott does not inform the media of his withdrawal, and reporters do not learn of it until almost the end of January. Scott makes the withdrawal three days after being sworn in as governor. Rock musician Ted Nugent, an outspoken conservative, calls Attorney General Eric Holder a “racist punk” in a Washington Times column. Holder is African-American. Nugent is writing in response to Holder’s recent request that the city of Dayton, Ohio, lower the passing threshold on the test to become a police officer because not enough black recruits passed the exam. Nugent does not inform his readers that the Justice Department originally sued Dayton over the exams in September 2008, while Bush appointee Michael Mukasey was attorney general, nor that the department settled the lawsuit in February 2009. Instead, Nugent calls the request “yet another ugly, blatant, and defining racist move” for the Obama Justice Department, writing: “Instead of attracting the best and brightest to serve the public, racist Mr. Holder will now ensure that the good residents of Dayton will be protected by dunce cops who score the equivalent of a D or F on the entrance exam.… What Mr. Holder clearly wants by forcing his racist substandards on the good citizens of Dayton is to ensure people he favors get a fair shake at becoming cops by lowering the standards to such a degree that there might as well not be any entrance exams.” Nugent says Holder may invite members of the New Black Panther Party to move to Dayton and become police officers, “where they could then legally intimidate white citizens without fear of reprisal from Mr. Holder’s Department of Injustice. If the citizens complained, he could scold them and call them ‘racial cowards.’” Holder wants to stuff the Dayton Police Department with “functionally illiterate” blacks, Nugent asserts: “the very bottom of the barrel.” He concludes: “Racism lives, and it lives in the Obama crony administration. Trump has touted his racial sensitivity, often discussing the importance of the civil rights movement and writing about his dream of an America unencumbered by “racism, discrimination against women, or discrimination against people based on sexual orientation.” Trump once donated office space to Jesse Jackson’s civil rights group, the Rainbow/PUSH Coalition, once hosted an NAACP convention party, and likes to be seen in public with African-American celebrities such as P. Justice Department Charges of Discrimination against Housing Applicants - In October 1973, Trump was still working with his father Fred Trump’s Trump Organization, which made millions from building thousands of units of middle-class housing in Brooklyn and Queens. Donald Trump had just been made president of the company. The Justice Department accused the Trump firm of serious violations of the Fair Housing Act, including refusing to rent or negotiate rentals “because of race and color,” misrepresenting to blacks that apartments were not available, and charging minorities higher rents. Donald Trump sued the federal government for making baseless charges, and accused the government of “trying to force [the firm] to rent to welfare recipients.” Trump added that if welfare recipients were allowed into his apartments in certain middle-class outer-borough neighborhoods, there would be a “massive fleeing from the city of not only our tenants, but communities as a whole.” A federal judge dismissed Trump’s lawsuit, calling it a waste of “time and paper,” and Trump settled with the Justice Department, not admitting guilt but agreeing to a number of conditions that would open Trump housing to more nonwhites. In 1978, the government charged Trump with failing to adhere to the agreement, saying that the Trump company “discriminated against blacks in the terms and conditions of rental, made statements indicating discrimination based on race, and told blacks that apartments were not available for inspection and rental when, in fact, they are.” In 1983, many Trump developments still had 95 percent white occupancies. Called for Death Penalty for Blacks Accused of Rape - In 1989, Trump took out full-page ads calling for the death penalty for three African-American teenagers accused of raping a white jogger in Central Park. The three teenagers were later exonerated. One of the defendant’s lawyers, Colin Moore, compared Trump’s stance to the racist attitudes expressed in the 1930s during the infamous “Scottsboro Boys” case. Trump tried to mend relations by visiting a black woman who had been raped and thrown off the roof of a building in the hospital, promising to pay her medical expenses.
Trump: Blacks 'Have the Actual Advantage Today' - Later in 1989, Trump told NBC interviewer Bryant Gumbel, “If I was starting off today, I would love to be a well-educated black because I really do believe they have the actual advantage today.” Orlando Sentinel columnist David R. Porter responded: “Too bad Trump can’t get his wish. Then he’d see that being educated, black and over 21 isn’t the key to the Trump Tower. Trump: 'Laziness Is a Trait in Blacks' - John R. O’Donnell, the former president of Trump Plaza Hotel and Casino who in 1991 published a biography of Trump, wrote that Trump said “laziness is a trait in blacks,” and once exclaimed: “Black guys counting my money! I hate it. The only kind of people I want counting my money are little short guys that wear yarmulkes every day.” In 1997, Trump admitted to a Playboy interviewer that “[t]he stuff O’Donnell wrote about me is probably true,” and went on to call O’Donnell “a f_cking loser” whom Trump barely knew. Law professor John Yoo, who during his tenure at the Justice Department wrote memos defending torture and the right of the executive branch to conduct its business in secret (see March 1996, September 25, 2001, September 25, 2001, October 4, 2001, October 23, 2001, October 23, 2001, November 2, 2001, November 5, 2001, and November 6-10, 2001), co-authors an article for the far-right American Enterprise Institute that attacks the Obama administration for considering the idea of an executive order to require government contractors to disclose their political contributions (see April 20, 2011 and May 26, 2011). The article, by Yoo and lawyer David W. Marston, is entitled “Overruling Citizens United with Chicago-Style Politics,” a reference to some of the unsavory and often-illegal political machinations undertaken by Chicago Democrats. The article repeatedly compares the Obama administration to the Nixon administration’s attempts to “use the available federal machinery to screw [their] political enemies,” as Yoo and Marston quote from a 1971 Nixon White House memo. Yoo and Marston say that the Obama administration, in an effort to recoup its losses from the Citizens United decision (see January 21, 2010]), “is making an unprecedented assault on free speech” by considering the executive order and by pushing the DISCLOSE Act (see July 26-27, 2010). (Yoo and Marston claim that the DISCLOSE Act, if passed into law, “would have forced all those doing business with the government to give up their ability to participate in the political process, as is their right under the First Amendment, aside from just voting on Election Day.”) They write: “Under the guise of ‘transparency’ and ‘accountability,’ the order curtails constitutionally protected speech rights and opens the door for retaliation against those not supporting the administration politically,” and go on to observe that in their opinion, this “assault on free speech” (see January 21, 2010 and January 22, 2010) is being joined by “the media [and] defenders of free speech.” Yoo and Marston claim that the Founding Fathers intended for corporations and other entities to be able to involve themselves in politics entirely anonymously, citing the example of Alexander Hamilton, John Jay, and James Madison publishing the Federalist Papers under the nom de plume “Publius.” Indeed, Yoo and Marston write, “disclosure of political contributions may be a prelude to the thuggish suppression of political speech by harassment and intimidation,” and they cite the instances of boycotts, vandalism, and death threats against people in California who donated money in support of Proposition 8, which declared gay marriage illegal. “Mandated disclosure of financial support for a political viewpoint can become the springboard for lawless retaliation against citizens for holding unpopular views,” the authors write. “Disclosure” and “transparency,” the “wonder drugs du jour,” are already “being used to silence core First Amendment speech rights and to threaten America’s long protection of anonymous political speech,” they contend, and claim that “thugs” are attempting to use violence and intimidation to nullify the Citizens United decision, force the issuance of the Obama executive order, and push the Federal Election Commission (FEC) to expand disclosure requirements. Only allowing financial donors to remain secret, the authors say, protects their rights to free speech and political involvement. “[D]isclosure invites retaliation,” they argue; only secrecy can protect free speech. The authors even cite a case brought on behalf of the NAACP, in which the organization was allowed to keep its membership lists secret for fear of attacks on its members or their families by white supremacists. [American Enterprise Institute, 7/20/2011] Ian Millhiser, a legal expert for the liberal news Web site Think Progress, angrily rebuts Yoo and Marston’s claims. Millhiser, referencing Yoo’s opinions issued during his stint in the Bush administration, writes, “If there is anyone in the universe who should think twice before criticizing a government lawyer for enabling a president to break the law, it is John Yoo.” He goes on to criticize Yoo’s legal thinking in the article, noting that the Citizens United ruling held that “disclosure could be justified based on a governmental interest in ‘provid[ing] the electorate with information’ about the sources of election-related spending.” Millhiser writes: “President Obama’s proposed executive order provides the electorate with information about the sources of election-related spending. So Yoo’s entire argument can be rebutted in exactly two sentences.” After rebutting other portions of Yoo and Marston’s arguments, Millhiser concludes, “Yoo’s defense of corporate America’s power to secretly buy elections is weak even by his own tragically incompetent standards.” [Think Progress, 7/22/2011]
Rolling Stone reporter Ari Berman writes that Republican lawmakers across the nation have launched “an unprecedented, centrally coordinated campaign to suppress the elements of the Democratic vote that helped elect Barack Obama in 2008. Just as Dixiecrats once used poll taxes and literacy tests to bar black Southerners from voting, a new crop of GOP governors and state legislators has passed a series of seemingly disconnected measures that could prevent millions of students, minorities, immigrants, ex-convicts and the elderly from casting ballots.” The initiative is ostensibly to counter the “epidemic” of “voter fraud” that Republicans insist is not only plaguing the nation, but affecting the outcome of elections. (In 2007, the Brennan Center released a report that found the instance of voter fraud vanishingly small, and concluded that more people die by lightning strikes than commit voter fraud—see 2007). Judith Browne-Dianis of the Advancement Project tells Berman, “What has happened this year is the most significant setback to voting rights in this country in a century.” As far back as 1980, powerful Republican operative Paul Weyrich told evangelical leaders: “I don’t want everybody to vote. As a matter of fact, our leverage in the elections quite candidly goes up as the voting populace goes down.” In 2010, the American Legislative Exchange Council (ALEC), a group founded by Weyrich and funded in part by the billionaire Koch brothers (see 1977-Present, 1979-1980, 1981-2010, 1984 and After, Late 2004, May 6, 2006, April 15, 2009, May 29, 2009, December 6, 2009, November 2009, July 3-4, 2010, August 28, 2010, August 30, 2010, September 24, 2010, January 5, 2011, October 4, 2011, and February 14, 2011), began working to disenfranchise hundreds of thousands, perhaps millions, of legitimate voters, almost of all identified as being part of ethnic or gender groups that are more likely to vote Democratic. Thirty-eight states have submitted legislation designed to impede voting “at almost every step of the electoral process.”
Requiring Proof of Citizenship - Kansas and Alabama now require would-be voters to show proof of US citizenship before being allowed to vote.
Impeding Voter Registration - Florida and Texas have passed legislation making it more difficult for groups like the League of Women Voters, an organization widely considered to lean Democratic, to register new voters. Maine repealed same-day registration, which had been in effect since 1973 and had worked to significantly increase voter participation. The Florida legislature passed a law requiring groups to hand in voter registration forms within 48 hours of collection, and imposed what Berman calls “a barrage of onerous, bureaucratic requirements” and serious criminal penalties for those who fail to comply. As a result, many people who once volunteered to help register voters are afraid to do so again. The League of Women Voters says it will no longer operate in Florida, and called Florida’s efforts “good old-fashioned voter suppression.” The Florida statute took effect one day after its passage, under an emergency statute designed for “an immediate danger to the public health, safety or welfare.” Since 2009, Florida has arrested a total of three people for suspected voter fraud. Republican state senator Mike Fasano, one of the few in his party to oppose the restrictions on registrations, says, “No one could give me an example of all this fraud they speak about.”
Curbing Early Voting - Florida, Georgia, Ohio, Tennessee, and West Virginia have cut short early-voting periods. Six states have moved to impose new restrictions on voter registration drives. In 2004, then-Florida governor Jeb Bush (R-FL) said he thought early voting was “great.… It’s another reform we added that has helped provide access to the polls and provide a convenience. And we’re going to have a high voter turnout here, and I think that’s wonderful.” However, his successor Rick Scott (R-FL) does not agree, and neither do most Republicans. After analysis showed what a benefit early voting was for Obama’s numbers, early voting became a key target. Florida has cut early voting days from 14 to 8 days. Ohio, where early voting numbers gave Obama a narrow victory in 2008, has cut its early voting days from 35 to 11, with only limited hours on weekends. Both states have banned voting on the Sunday before elections, when many black churches historically mobilize their constituents. The Early Voting Information Center at Reed College states, “There is no evidence that any form of convenience voting has led to higher levels of fraud.”
Denying Convicted Felons the Right to Vote - Florida and Iowa have passed laws denying convicted felons the right to vote, disenfranchising thousands of previously eligible voters even if they have already served their sentences and have returned to society. Former Florida Governor Charlie Crist (R-FL) restored the voting rights of 154,000 felons convicted of non-violent crimes. In March 2011, after 30 minutes of public debate, Governor Scott overturned that decision, instantly disenfranchising almost 98,000 citizens and prohibiting another 1.1 million convicts from being allowed to vote after they are released from prison. Former President Bill Clinton asked in July: “Why should we disenfranchise people forever once they’ve paid their price? Because most of them in Florida were African-Americans and Hispanics and would tend to vote for Democrats—that’s why.” Iowa Governor Terry Branstad (R-IA) recently took a similar action, overturning his predecessor’s decision to restore voting rights to some 100,000 ex-felons. Until recent years, Iowa saw up to five percent of its residents ineligible to vote, including 33 percent of its African-American residents. Florida, Iowa, Kentucky, and Virginia require former felons to apply for the right to vote to be restored.
Voter Identification - Six states—Alabama, Kansas, South Carolina, Tennessee, Texas, and Wisconsin, all controlled by Republican governors and legislatures—have passed laws requiring an official government ID to cast a ballot. Berman notes that some 10 percent of US citizens lack such identification, and the number of young and black voters, groups that traditionally lean Democratic, are much higher. The turn towards voter ID requirements began in 2008, when the US Supreme Court upheld an Indiana photo-ID requirement even though state lawyers could not produce a single instance of the kind of voter fraud that photo ID laws are designed to prevent. After the ruling, ALEC orchestrated a nationwide move towards photo ID requirements. ALEC wrote draft legislation for Republican legislators based on Indiana’s ID requirement. Five of the states that passed those laws had their legislation submitted by legislators who belong to ALEC. Heather Smith, president of the voter-registration group Rock the Vote, says: “We’re seeing the same legislation being proposed state by state by state. And they’re not being shy in any of these places about clearly and blatantly targeting specific demographic groups, including students.” In Texas, the Republican-dominated legislature passed “emergency” legislation that was signed into law by Governor Rick Perry saying that a concealed-weapons permit is acceptable ID, but a college ID is not. Republicans in Wisconsin effectively disenfranchised every college student by requiring that acceptable IDs contain information that no colleges put on their IDs. Dane County board supervisor Analiese Eicher says, “It’s like creating a second class of citizens in terms of who gets to vote.” In Wisconsin, for example, about half of African- and Hispanic-American citizens do not have a driver’s license, and the state has an extremely small number of Department of Motor Vehicles (DMV) offices—some of which are only open one day a month. Governor Scott Walker (R-WI) attempted to close 16 DMV offices, all in heavily Democratic-voting areas. Berman notes, “Walker planned to close a DMV in Fort Atkinson, a liberal stronghold, while opening a new office 30 minutes away in the conservative district of Watertown.” Democratic governors in five states—Minnesota, Missouri, Montana, New Hampshire, and North Carolina—have all vetoed ID laws. Voters in Mississippi and Montana are considering ballot initiatives requiring voter IDs. Legislation is currently pending in Pennsylvania. Perhaps the most restrictive law was signed into effect by South Carolina Governor Nikki Haley (R-SC). Voters must have a free state ID to vote—but they must pay for a passport or birth certificate. Brown-Dianis says, “It’s the stepsister of the poll tax.” Many elderly black residents who were born at home in the segregated South and were never issued birth certificates can no longer vote unless they go to family court to prove their identity.
Significant Impact on 2012 Voting - Berman writes that when these measures are taken in the aggregate, the turnout of Democrats to the 2012 votes will be significantly smaller, perhaps enough to throw races to Republican candidates. In July, Clinton told a group of student activists: “One of the most pervasive political movements going on outside Washington today is the disciplined, passionate, determined effort of Republican governors and legislators to keep most of you from voting next time. Why is all of this going on? This is not rocket science. They are trying to make the 2012 electorate look more like the 2010 electorate than the 2008 electorate.” Clinton was referring to the 2010 elections, widely considered a Republican “wave” election in part because of far smaller turnouts among young and minority voters than in 2008, and because of a large number of “tea party” voters. Clinton added, “There has never been in my lifetime, since we got rid of the poll tax and all the Jim Crow burdens on voting, the determined effort to limit the franchise that we see today.”
Cracking Down on Voter Fraud? - Republicans insist that voter fraud is rampant in America. Since George W. Bush took office in 2001 after losing the popular vote (see 9:54 p.m. December 12, 2000), his administration made “voter fraud” a top priority for Justice Department prosecutors. In 2006, the DOJ fired two US Attorneys who refused to prosecute patently fraudulent voter fraud allegations. Bush advisor Karl Rove called voter fraud “an enormous and growing problem.” He told the Republican National Lawyers Association that America is “beginning to look like we have elections like those run in countries where the guys in charge are colonels in mirrored sunglasses.” The Republicans successfully destroyed the community activism group ACORN (Association of Community Organizations for Reform Now) after false allegations were made that it was, as Berman writes, “actively recruiting armies of fake voters to misrepresent themselves at the polls and cast illegal ballots for the Democrats.” A massive DOJ probe in 2006 and 2007 failed to prosecute a single person for intentionally impersonating another person at the polls, an action that the DOJ claimed was at the heart of the voter fraud investigation. Eighty-six cases of voter fraud did win convictions, but most of those were immigrants and former felons who did not intentionally cast illegal votes. An enormous investigation in Wisconsin resulted in 0.0007 percent of the electorate being prosecuted for voter fraud. And the Brennan Center report found the instance of voter fraud in America extraordinarily small (see 2007).
Voter Fraud Allegations Dog Obama Victory - Republican lawmakers and activists made a raft of allegations after the November 2008 elections that placed the White House in the hands of Barack Obama (D-IL). The 29 states that register voter affiliation showed a roughly 2-1 increase in new Democratic voters over Republicans for 2008, and Obama won almost 70 percent of those votes. Election reform expert Tova Wang says flatly, “This latest flood of attacks on voting rights is a direct shot at the communities that came out in historic numbers for the first time in 2008 and put Obama over the top.” Berman cites Kansas Secretary of State Kris Kobach as emblematic of the Republican pushback against the Obama victory. Kobach is a former Bush-era Justice Department advisor who helped push through his state’s requirement that every voter prove his or her citizenship, ignoring the fact that Kansas has prosecuted exactly one case of voter fraud since 2006. Kobach used fear of illegal immigrants to help push his requirement through, stating without evidence, “In Kansas, the illegal registration of alien voters has become pervasive.” He also stated that many people were casting ballots in the name of dead voters, and cited the example of Alfred K. Brewer as a dead voter who mysteriously voted in 2008. However, as the Wichita Eagle showed, Brewer is very much alive. “I don’t think this is heaven,” Brewer told the Eagle, “[n]ot when I’m raking leaves.” Representative John Lewis (D-AL), a civil rights crusader who was brutally beaten during the 1960s effort to win voting rights for African-Americans, says bluntly, “Voting rights are under attack in America.” On the House floor in July, Lewis told the assemblage, “There’s a deliberate and systematic attempt to prevent millions of elderly voters, young voters, students, minority and low-income voters from exercising their constitutional right to engage in the democratic process.”
Fighting Voter Disenfranchisement - Voting-rights organizations are fighting back as best they can. The American Civil Liberties Union (ACLU) is challenging several of the new voter-restriction laws in court. Congressional Democrats are pushing the Department of Justice to block or weaken laws that impede minority voters from exercising their rights. Lewis says, “The Justice Department should be much more aggressive in areas covered by the Voting Rights Act.” Meanwhile, many voting-rights experts predict chaos at the polls in November 2012, as voters react with confusion, frustration, and anger at being barred from voting. “Our democracy is supposed to be a government by, of, and for the people,” says Browne-Dianis. “It doesn’t matter how much money you have, what race you are, or where you live in the country—we all get to have the same amount of power by going into the voting booth on Election Day. But those who passed these laws believe that only some people should participate. The restrictions undermine democracy by cutting off the voices of the people.” [Rolling Stone, 8/30/2011]

Presidential candidate Newt Gingrich explains why he feels the president can arrest judges with whom he disagrees. [Source: CBS News / Talking Points Memo]Republican presidential candidate Newt Gingrich (R-GA) tells a CBS audience that if he becomes president, he would send federal law enforcement officials to arrest judges who make rulings he finds unacceptable. Interviewed by CBS’s Bob Schieffer, he says the president should send Capitol Police officers or US Marshals to arrest “activist” judges who make controversial rulings, and compel them to appear before Congress to justify their decisions. Schieffer asks: “Let me just ask you this and we’ll talk about enforcing it, because one of the things you say is that if you don’t like what a court has done, the Congress should subpoena the judge and bring him before Congress and hold a congressional hearing. Some people say that’s unconstitutional. But I’ll let that go for a minute. I just want to ask you from a practical standpoint, how would you enforce that? Would you send the Capitol Police down to arrest him?” Gingrich responds he would if he “had to,” and continues, “Or you instruct the Justice Department to send the US Marshal.” A judge who issues what Gingrich calls a “radical” ruling would be forced to explain his ruling before Congress, Gingrich says: “I would then encourage impeachment, but before you move to impeach him you’d like to know why he said it.” If the judge refuses to appear under his own power, federal law enforcement officials are empowered to bring them in to testify involuntarily, he says: “I mean, you’re raising the core question—are judges above the rest of the constitution or are judges one of the three co-equal branches?… You have an increasingly arrogant judiciary. The question is: Is there anything we the American people can do? The standard answer has been eventually we’ll appoint good judges. I think that’s inadequate. The Constitution promises a balance of the judicial branch, the executive branch, and the legislative branch. The Federalist Papers say specifically the weakest of the three branches is the judiciary.” Schieffer says: “You know, the old saying in legal circles is that the Supreme Court is not last because it’s right. It’s right because it’s last. There comes a point where you have to accept things as the law of the land. How does the president decide what is a good law—and I’m going to obey the Supreme Court—or what’s a bad law and I’m just going to ignore it.” Gingrich replies: “I think it depends on the severity of the case. I’m not suggesting that the Congress and the president review every decision. I’m suggesting that when there are decisions… in which they are literally risking putting civil liberty rules in battlefields. I mean it is utterly irrational for the Supreme Court to take on its shoulders the defense to the United States. It is a violation of the Constitution.” Reporter Sam Stein notes that the day before, Gingrich held a half-hour telephone call with donors and supporters in which he pledged that if elected president, he would abolish courts and eliminate “activist judges” he considers “outside the mainstream or infringing too deeply on the commander in chief’s authority.” Many judicial experts consider Gingrich’s stance to be flatly unconstitutional. Former Attorney General Michael Mukasey, who served in the recent Bush administration, has called Gingrich’s ideas about the judiciary “dangerous, ridiculous, totally irresponsible, outrageous, off-the-wall, and [likely to] reduce the entire judicial system to a spectacle.” Bert Brandenburg of the nonpartisan Justice at Stake organization says: “Overall, he’s racing towards a cliff. It may be expedient to appeal to specific voters in primaries or caucuses, but it’s a constitutional disaster. Americans want courts that can uphold their rights and not be accountable to politicians. When you get to the point where you’re talking about impeaching judges over decisions or abolishing courts or calling them before Congress, it’s getting very far away from the American political mainstream.” Two of Gingrich’s Republican presidential challengers, Mitt Romney (R-MA) and Ron Paul (R-TX), publicly disagree with Gingrich’s position, with Paul calling the idea of compelling judges to appear before Congress “a real affront to the separation of the powers.” Michael McConnell, director of the Constitutional Law Center at Stanford University and a former federal appeals judge appointed by President Bush, says conservatives “should not be cheering” and “are misled” if they believe Gingrich’s ideas are in their best interests, especially considering many conservatives are relying on the Supreme Court to find President Obama’s health care legislation unconstitutional. He says: “You would think that this would be a time when they would be defending the independence of the judiciary, not attacking it. You can’t have it both ways. It can’t be that when conservative Republicans object to the courts, they have the right to replace judges, and when liberal Democrats disapprove of the courts, they don’t. President Obama signs a controversial bill passed by Congress (see December 15, 2011), which gives the president power to order indefinite military detention for anyone deemed an enemy combatant, including US citizens arrested or captured in the United States. Obama had threatened to veto the 2012 National Defense Authorization Act (NDAA) on a number of occasions, but once certain restrictions on presidential authority were removed, he became willing to sign it. For instance, the original version of the bill required that persons covered by the bill be held prisoner by the military and prosecuted by military tribunals, if at all. Obama was of the view that by requiring military detention, Congress was intruding on areas under the purview of the executive branch, and in ways that would impede the ability of the executive branch to effectively gather intelligence, fight terrorism, and protect national security. He also believed the bill was unnecessary and potentially risky in order to codify detention authority, and that the president already had authority, via the 2001 Authorization to Use Military Force (AUMF) and subsequent court rulings, to unilaterally designate persons, including US citizens, as enemy combatants and subject them to indefinite military detention without trial. [White House, 12/31/2011; Salon, 12/15/2012] For the same reasons, Secretary of Defense Leon Panetta, CIA Director David Petraeus, FBI Director Robert Mueller, Director of National Intelligence James Clapper, White House Advisor for Counterterrorism John Brennan, and DOJ National Security Division head Lisa Monaco were also opposed to the mandatory military detention provisions. [ACLU, 12/7/2011] Also, according to Senator Carl Levin (D-MI), a sponsor of the NDAA, “[L]anguage which precluded the application of section 1031 [1021 in the final bill] to American citizens was in the bill we originally approved in the Armed Services Committee, and the administration asked us to remove the language which says that US citizens and lawful residents would not be subject to this section.” [Senate, 11/17/2011] With the bill drafted so that military detention was optional, and an option US citizens were subject to (see December 15, 2011), Obama signaled he would sign it, despite having concerns that it was still unduly restrictive of executive authority, and it unnecessarily codified authority that had been exercised for 10 years and had been upheld by a number of lower court decisions. [White House, 12/17/2011 ] However, in a non-binding signing statement attached to the bill, Obama says he is signing the bill “despite having serious reservations with certain provisions that regulate the detention, interrogation, and prosecution of suspected terrorists.” Obama does not specify what his reservations are, but promises: “[M]y administration will not authorize the indefinite military detention without trial of American citizens. Controversy over Indefinite Detention Provisions - Though 86 percent of US senators and almost two-thirds of the House of Representatives voted to pass the NDAA (see December 15, 2011), and the bill is signed by Obama, the military detention measures are opposed by a number of constitutional experts and public interest organizations, and a significant percentage of the general public (see December 22-26, 2011).

US District Court Judge Katherine B. Forrest (Southern Division, New York) finds a controversial section of the 2012 National Defense Authorization Act (NDAA) unconstitutional and issues a preliminary injunction barring enforcement. Section 1021(b)(2) of the NDAA authorizes indefinite military detention without trial of any person “who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces” (see December 15, 2011). The law makes no exception for US persons. It has been under review by the court because seven individuals (journalists, activists, and politicians) sued, alleging this section is unconstitutional because it violates their First Amendment right to freedom of speech and association and Fifth Amendment right to due process, and that it imposes military jurisdiction on civilians in violation of Article III and the Fifth Amendment (see January 13, 2012). Judge Finds NDAA Undermines Protected Speech and Association - The plaintiffs argued that, due to their association with and/or reporting on al-Qaeda and the Taliban in the course of their work as journalists and activists, they might be subject to detention under § 1021, and that, due to the vagueness of the law, there was no way to know if the law could be used against them. In testimony and briefs, the plaintiffs gave examples of how they had altered their speech and behavior out of fear they might be subject to detention. In her Opinion and Order, Forrest notes: “The Government was unable to define precisely what ‘direct’ or ‘substantial’ ‘support’ means.… Thus, an individual could run the risk of substantially supporting or directly supporting an associated force without even being aware that he or she was doing so.” And: “The Government was given a number of opportunities at the hearing and in its briefs to state unambiguously that the type of expressive and associational activities engaged in by plaintiffs—or others—are not within § 1021. It did not. This Court therefore must credit the chilling impact on First Amendment rights as reasonable—and real. Judge Rejects All Three Arguments Made by the Government - Forrest summarizes the government’s position in this way: “[F]irst, that plaintiffs lack standing; second, that even if they have standing, they have failed to demonstrate an imminent threat requiring preliminary relief; and finally, through a series of arguments that counter plaintiffs’ substantive constitutional challenges, that Section 1021 of the NDAA is simply an ‘affirmation’ or ‘reaffirmation’ of the authority conferred by the 2001 Authorization for Use of Military Force.” Rejecting the first and second arguments, Forrest finds the plaintiffs do have standing because their fear of imminent indefinite detention without charge or trial is reasonable, due to the vagueness of § 1021 and the government’s failure to state that the plaintiff’s activities aren’t covered under section 1021, leaving the plaintiffs with no way of knowing if they might be subject to detention. Furthermore, Forrest finds the plaintiffs have suffered actual harm, evidenced by incurring expenses and making changes in speech and association due to fear of potential detention. Regarding the third argument, Forrest rejects the idea that § 1021 could simply be affirming the AUMF, because “[t]o so hold would be contrary to basic principles of legislative interpretation that require Congressional enactments to be given independent meaning”; otherwise § 1021 would be “redundant” and “meaningless.” Furthermore, Forrest finds § 1021 of the NDAA is substantively different than the AUMF; it is not specific in its scope and “lacks the critical component of requiring… that an alleged violator’s conduct must have been, in some fashion, ‘knowing.’” [OPINION AND ORDER: 12 Civ. 331 (KBF) Hedges et al v. Judge Finds Lawsuit Will Likely Succeed on Merits, Justifying Injunction - Based on the information put forward by the seven plaintiffs and the government, Forrest concludes the lawsuit will likely succeed on its merits, thus it should be allowed to proceed, stating: “This Court is left then, with the following conundrum: plaintiffs have put forward evidence that § 1021 has in fact chilled their expressive and associational activities; the Government will not represent that such activities are not covered by § 1021; plaintiffs’ activities are constitutionally protected. Given that record and the protections afforded by the First Amendment, this Court finds that plaintiffs have shown a likelihood of succeeding on the merits of a facial challenge to § 1021.” Forrest also notes that issuing a preliminary injunction barring enforcement is unusual, but called for given the evidence and circumstances, stating: “This Court is acutely aware that preliminarily enjoining an act of Congress must be done with great caution. President Obama’s Justice Department files a motion urging a federal judge to reconsider a ruling and order that blocked enforcement of a law authorizing indefinite military detention. The case is Hedges v. Obama and the law at issue is section 1021 of the 2012 National Defense Authorization Act (NDAA). The filing calls Judge Katherine B. Forrest’s preliminary injunction barring enforcement of Section 1021(b)(2) of the NDAA (see May 16, 2012) “extraordinary” as it restricts the president’s authority during wartime. It also questions whether “an order restraining future military operations could ever be appropriate,” and disputes Forrest’s finding that the plaintiffs who had sued to overturn the law (see January 13, 2012) have standing to sue. A federal judge denies the US government’s request (see May 25, 2012) to reconsider her order (see May 16, 2012) blocking enforcement of a law authorizing indefinite military detention, without charge or trial, of anyone, including US citizens arrested in the United States, accused of supporting groups hostile to the United States. Section 1021 of the 2012 National Defense Authorization Act (NDAA—see December 15, 2011) is under review in the case of Hedges v. Obama (see January 13, 2012) and Judge Katherine B. Forrest of the US District Court, New York Southern Division had issued a preliminary injunction enjoining enforcement of the law after finding it unconstitutional.
Controversy over Scope of Detention Authority - The US government had also stated in its request for reconsideration that it was interpreting Forrest’s order as applying only to the plaintiffs in the case. Forrest clarifies in her subsequent Memorandum Opinion and Order that by enjoining enforcement of § 1021(b)(2), the only remaining persons the law can be applied to are those defined in § 1021(b)(1): “A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.” This definition of covered persons is the same as the one given in the 2001 Authorization for Use of Military Force, passed by Congress following the September 11 attacks (see September 14-18, 2001). The Supreme Court has only ruled on a narrow range of relevant detention issues; one oft-cited case is Hamdi v. Rumsfeld (see June 28, 2004). Lower courts have produced a variety of opinions, some upholding an expansive view of detention authorities, others challenging it. In § 1021 of the NDAA, Congress asserted that it “affirms” detention authority granted under the AUMF, and does not “expand… the scope of the [AUMF].” Senator Carl Levin (D-MI), during a debate on the NDAA, explained the language in this way: “[W]e make clear whatever the law is. It is unaffected by this language in our bill” (see December 15, 2011). Congress included a separate, broader definition of covered persons in § 1021(b)(2) that potentially covered anyone alleged by the government to have supported groups hostile to the US, including US citizens arrested in the United States. This section is what prompted Hedges to sue, alleging these provisions violated his First and Fifth Amendment rights (see January 13, 2012). Forrest found the bill’s broad and vague provisions for indefinite military detention to be unconstitutional, and Congress’s statement that it was only affirming established law to be “contrary to basic principles of legislative interpretation that require Congressional enactments to be given independent meaning” (see May 16, 2012). Rolling Stone magazine reports that despite no evidence of voter fraud except in extremely isolated incidents, Republicans in over a dozen states are passing laws that disenfranchise voters under the guise of “protecting the vote” (see August 30, 2011). The voters most affected by these laws, the magazine reports, are more likely to vote Democratic in national and state elections. Governor Rick Scott (R-FL), who is fighting the Justice Department to allow him to purge hundreds of thousands of voters from the state electoral rolls, has said: “We need to have fair elections. When you go out to vote, you want to make sure that the other individuals that are voting have a right to vote.” However, a 2007 study by the Brennan Center for Justice at New York University School of Law shows that almost every allegation of voter fraud is false. The chance of a vote being fraudulent, according to the study, is 0.0004 percent (see 2007).
Double Voting - Many claim that “double voting,” or a single voter casting a vote twice or more, is a rampant issue. In reality, it almost never occurs. The allegations that are made almost always result from different people with similar or even identical names casting separate votes, or simple clerical errors, such as voters being counted as having cast their ballots when in reality they did not. In Missouri in 2000 and again in 2002, hundreds of “double votes” were alleged to have been cast, with some allegations saying that the same voter cast their votes in Kansas and Missouri. When reporters and other investigators looked into the claims, only four cases were shown to have been actual double voting, for a documented fraud rate of 0.0003 percent.
Dead Voters - These are allegations that living people cast ballots using the names of dead voters. Almost every allegation of this nature has proven to stem from flawed matches of death records and voter rolls. In the 2000 Georgia elections, allegations of 5,412 “dead voter” votes were made over the last 20 years. All but one of those allegations turned out to be an incorrect match between death records and voter rolls. One example: “Alan J. Mandel,” who died in 1997, apparently cast a vote in 1998. In reality, voter Alan J. Mandell—two Ls—cast a legitimate vote. Election workers checked the wrong name off their list.
Voting with Fraudulent Addresses - The allegation is that people use fraudulent addresses to register to vote. Such allegations usually stem from mail coming back from the given address marked undeliverable. In almost every instance, the person in question has moved, the individual piece of mail was misdelivered or misaddressed, or the address is recorded incorrectly. In one instance, New Hampshire election officials became concerned when 88 voters had registered to vote using similar addresses from property belonging to Daniel Webster College. The addressees were legitimate: all 88 voters were students at that school who lived on college property.
Voting by Convicted Felons - This is a favorite allegation: that convicted felons stripped of their right to vote have voted anyway. It happens more often than some other forms of alleged voter fraud, but in almost every case, the felon in question was unaware that his or her right to vote had been taken away, a misapprehension often reinforced by misinformed election officials. Even then, almost every instance of “felon voters” turns out to be a case of clerical error: someone was convicted of a crime that does not result in their right to vote being removed, typographical errors, voters with names similar to that of convicted felons, and so forth. In the 2000 Florida elections, the state claimed that 5,643 ineligible felons had cast illegal votes. The list provided by the state was almost completely populated by eligible voters who were misidentified as ineligible felons.
Voting by Noncitizens - Allegations that US elections are being “thrown” by huge numbers of illegal immigrants casting their votes are widespread. In reality, there is not one case of an illegal immigrant intentionally casting an illicit vote. For example, Washington state officials investigated the citizenship of 1,668 registered voters in 2005, after allegations that they were illegal aliens were raised based on their “foreign-sounding names.” Every one of the voters on the list was legitimate.
Registration Fraud - On occasion, fraudulent registration forms do get submitted. However, the number of cases where a person submitted a form in someone else’s name in order to impersonate that person is extremely small. Some people fill out the forms with deliberately ridiculous information (such as claiming their name to be “Mickey Mouse”), while others make honest mistakes filling out the forms. In a few cases, voter registration workers working on commission have committed fraud in order to make more money. The Brennan Center report found: “Most reports of registration fraud do not actually claim that the fraud happens so that ineligible people can vote at the polls. Indeed, we are aware of no recent substantiated case in which registration fraud has resulted in fraudulent votes being cast.”
Voting by Dogs - The Brennan Center found nine instances of people registering their dogs to vote. Six of those were from people trying to prove a point: that they could register their dogs to vote. (The penalty for registering a dog to vote is up to 30 years in federal prison.) The Brennan report documented two cases of someone casting a vote in the name of a dog. One was submitted in Venice, California, with the word “VOID” and a paw print drawn on the ballot, and another, also cast in Venice, California, was submitted under the name of “Raku Bowman.”
Vote Buying - Rolling Stone notes that this does happen on rare occasions, with campaign officials or others convincing voters to vote for a particular candidate in return for money, food, or cigarettes. But, the magazine notes, this is vote buying, not voter fraud. It, too, is illegal, and will not be curbed by voter ID laws and the like.
Fraud by Election Officials - Like vote buying, this happens on rare occasions, but is not voter fraud per se. Rolling Stone writes, “If election officials are willing to break the law, rules designed to restrict voting won’t stop them.” [Rolling Stone, 6/12/2012]
Casino billionaire Sheldon Adelson, one of the world’s 15 richest people, is on course to contribute at least $71 million to efforts to unseat President Obama in the November presidential elections and elect Republicans to national and state office (see February 21, 2012). Adelson’s contributions are cloaked in secrecy, as much of his contributions go to “nonprofit” political organizations that under the law do not have to disclose their donors. Adelson and his wife Miriam have already contributed $10 million to a “super PAC” backing Republican presidential candidate Mitt Romney (see June 13, 2012), and have either given or pledged to give up to $35 million to other organizations, including Crossroads GPS, a “nonprofit” organization led by former George W. Bush advisor and longtime Adelson friend Karl Rove, the Koch-financed Americans for Prosperity (AFP—see Late 2004, May 29, 2009, and November 2009), and another organization linked to House Majority Leader Eric Cantor (R-VA). Adelson is a strong supporter of Israel’s far-right government and a staunch opponent of US labor unions. Adelson has told friends that he may give up to $100 million in efforts to unseat Obama and elect Republicans in state races; indications are that he may give much, much more. Some of Adelson’s donations may go to another Koch-funded organization, the Center to Protect Patients’ Rights, which in 2010 was used to funnel tens of millions of dollars to other conservative organizations (see October 12, 2010). The Young Guns Network is a nonprofit group set up by Cantor, and has received $5 million from Adelson (see June 10, 2012). So has the “super PAC” the Congressional Leadership Fund, a group linked to House Speaker John Boehner (R-OH). Adelson’s Las Vegas casino The Sands is under investigation by the Securities and Exchange Commission (SEC) and the Justice Department for possible violations of the Foreign Corrupt Practices Act, which exists to prevent bribery of foreign business officials. The Sands denies any wrongdoing. Adelson previously backed Romney’s opponent Newt Gingrich (R-GA), but as Gingrich’s hopes for the presidential nomination faded, Adelson indicated that he would shift his support to Romney. Adelson has told GOP colleagues he intends to make most of his contributions to nonprofits like Crossroads GPS, which are not required to make the names of their donors, or the amounts of their donations, public. Although the law bars candidates like Romney from soliciting donations exceeding $5,000, Republican fundraisers say that candidates and their representatives have flocked to Adelson in recent months, as have representatives from organizations such as the US Chamber of Commerce, which intends to spend $50 million in efforts to elect Republicans to Congress. The nonprofit Republican Jewish Coalition has received millions from Adelson in the past, and says it intends to spend some $5 million this year on behalf of candidates such as Josh Mandel (R-OH), running to unseat Senator Sherrod Brown (D-OH). Adelson also donated $250,000 to help turn back efforts to recall Governor Scott Walker (R-WI) and $250,000 to a political committee backing Governor Rick Scott (R-FL), who is battling the Justice Department to be allowed to purge hundreds of thousands of minority voters from the voting rolls. Judge Robert Hinkle. [Source: Eddie Curran]US District Judge Robert Hinkle rejects an attempt by the US Department of Justice to block Florida’s attempted purge of what it calls non-citizens, in part because Florida has temporarily suspended the purge. Hinkle says that federal law prohibiting the systematic removal of voters in the months before an election does not apply to non-citizens. Hinkle also accepts Florida’s assurance that it has ended its purge efforts. The Justice Department argued that the purge violates the National Voter Registration Act of 1993 (NVRA—see May 20, 1993), which makes it illegal to perform what the law calls a systematic removal of voters before a federal election. Florida’s primary will be held on August 14. In 2011, Florida’s state motor vehicle agency created a database of some 2,600 people whose citizenship was determined to be “questionable,” but county election supervisors stopped using the database to remove voters from their rolls after concluding the list was unreliable and contained the names of many eligible voters. Justice Department lawyer John Bert Ross called Florida’s effort to purge “non-citizens” a “dragnet” that illegally forces US citizens to prove their legitimacy, though Ross was unable to cite an instance of a legitimate voter being removed from the voting rolls. Ross asked Hinkle to restore the voting rights of everyone purged from the voting rolls, a request that Hinkle rejected, saying: “Leaving ineligible voters on the list is not a solution. Non-citizens should not be voting. People need to know we are running an honest election.” The Florida Secretary of State, Ken Detzner, is suing for access to a US Department of Homeland Security (DHS) database to “better ascertain the citizenship status of voters,” according to Detzner’s attorney Michael Carvin. DHS has so far refused the request. Carvin says that if Detzner receives the data, “I do expect the state to proceed [with the purge] and protect the integrity of the voter rolls.” Hinkle accepts the state’s arguments that it is carrying out its duty to make sure non-citizens do not “dilute” the votes of actual citizens. Hinkle showed some concern that over half of the people on Florida’s “purge list” are Hispanic, saying: “That’s discriminatory, at least in effect. I don’t suggest that that was the purpose of this.” Hinkle also chided Collier County for sending letters to “potential non-citizens” challenging whether people born in Puerto Rico are legitimate US citizens. People born in Puerto Rico are US citizens by law. Collier County elections staffer Tim Durham says the county never sent such a letter. Hinkle says that with the elections approaching, “[t]he federal government and the state government ought to be working together to try to minimize the mistakes” instead of trying to settle the problem in court. Florida Governor Rick Scott (R-FL) praises the ruling, saying, “The court made a commonsense decision consistent with what I’ve been saying all along: that irreparable harm will result if non-citizens are allowed to vote.” Democrats say Scott is trying to suppress legitimate votes in Florida; liberal advocacy group MoveOn.org calls the purge “racist” because of its focus on Hispanics.
