Islamist militant leader Abu Musab al-Zarqawi and his group al-Tawhid pledges loyalty to bin Laden in a statement posted on the Internet. He states, [Let it be known that] al-Tawhid pledges both its leaders and its soldiers to the mujahid commander, Sheikh Osama bin Laden…” [Bergen, 2006, pp. 364] Bin Laden and al-Zarqawi began discussing the possibility of an alliance in early 2004 (see Early 2004). There had been other occasional contacts and linkages between al-Zarqawi and his group in years past, but al-Zarqawi had generally maintained his independence from al-Qaeda. Just one month earlier, al-Zarqawi stated, “I have not sworn allegiance to [bin Laden] and I am not working within the framework of his organization.” [Newsweek, 4/4/2005] The Atlantic Monthly will later report that at the same time al-Zarqwai made his loyalty oath, he also “proclaimed himself to be the ‘Emir of al-Qaeda’s Operations in the Land of Mesopotamia,’ a title that subordinated him to bin Laden but at the same time placed him firmly on the global stage. One explanation for this coming together of these two former antagonists was simple: al-Zarqawi profited from the al-Qaeda franchise, and bin Laden needed a presence in Iraq. Another explanation is more complex: bin Laden laid claim to al-Zarqawi in the hopes of forestalling his emergence as the single most important terrorist figure in the world, and al-Zarqawi accepted bin Laden’s endorsement to augment his credibility and to strengthen his grip on the Iraqi tribes. Both explanations are true. It was a pragmatic alliance, but tenuous from the start.” [Atlantic Monthly, 6/8/2006] In December 2004, an audiotape said to be the voice of bin Laden acknowledges al-Zarqawi’s comments. “It should be known that the mujahid brother Abu Musab al-Zarqawi is the emir of the al-Qaeda organization in [Iraq]. The brothers in the group there should heed his orders and obey him in all that which is good.” [Bergen, 2006, pp. 364-365]

[Source: New York Times]The US media learns that Iraq’s interim government reports that nearly 380 tons of powerful conventional explosives, used to demolish buildings, make missile warheads, and detonate nuclear weapons, are missing from a former military installation (see October 10, 2004). The facility, Al Qaqaa, was supposed to be under US control but in reality is “a no-man’s land,” in the words of the New York Times, “picked over by looters as recently as” October 24. UN inspectors and the International Atomic Energy Agency (IAEA) had monitored the huge cache of explosives for years. The IAEA says that machine tools usable for either nuclear or non-nuclear purposes are also missing. White House and Pentagon inspectors admit that the explosives disappeared some time after the US-led invasion of Iraq. National Security Adviser Condoleezza Rice was informed of the missing explosives within the last month; according to the Times, “[i]t is unclear whether President Bush was informed.” US officials began answering questions about the missing explosives after reporters from the Times and CBS’s “60 Minutes” began asking questions. The CIA’s Iraq Survey Group has been asked to investigate the disappearance.
Similar Explosives Used in Other Terrorist Attacks - The immediate concern, according to US officials, is the explosives’ possible use in major bombing attacks against American and/or Iraqi forces. The explosives, mainly HMX and RDX, can be used in bombs strong enough to destroy airplanes or large buildings. The Times notes that the bomb that brought down Pan Am Flight 103 over Lockerbie, Scotland (see After December 21, 1988) used less than a pound of such explosive. Larger amounts of the same kinds of explosives were used in the November 2003 Riyadh bombings (see May 12, 2003) and a September 1999 bombing of a Moscow apartment complex (see September 9, 1999 and September 13, 1999). The explosives can also be used to trigger a nuclear weapon, the primary reason why it had been, until the invasion, monitored by UN inspectors from the IAEA.
Repeated IAEA Warnings - The IAEA had publicly warned about the danger of the Al Qaqaa explosives before the invasion, and after the overthrow of the Iraqi government, IAEA officials specifically told US officials that they needed to keep the facility locked down (see May 2003). Pentagon spokesman Lawrence Di Rita says that the missing explosives need to be kept in perspective, as US and allied forces “have discovered and destroyed perhaps thousands of tons of ordnance of all types.” Iraq’s Minister of Science and Technology, Dr. Rashad Omar, tells Times and CBS reporters: “Yes, they [the 380 tons of explosives] are missing. We don’t know what happened.” Omar says that after the invasion, Al Qaqaa was the responsibility of the Coalition Provisional Authority, which served as Iraq’s de facto government until June 2004 (see June 28, 2004). “After the collapse of the regime, our liberation, everything was under the coalition forces, under their control,” he says. “So probably they can answer this question, what happened to the materials.” The CPA is defunct; Bush administration officials say they don’t know where the explosives could be. One senior official says that the Qaqaa complex was listed as a “medium priority” site on the CIA’s list of more than 500 sites that needed to be searched and secured during the invasion. “Should we have gone there? Definitely,” says one senior official. Another senior official says that US soldiers gave the Qaqaa facility a cursory inspection during the push towards Baghdad in early April, but “saw no bunkers bearing the IAEA seal.”
Refusal to Allow IAEA Inspections after Occupation - Satellite photos taken in late 2003 showed that two of the ten bunkers containing HMX had exploded, presumably from bombing during the US offensive, but eight remained relatively intact. The Bush administration refused to let the IAEA back into Iraq to inspect and verify the Qaqaa facility or any of the other stockpiles formerly monitored by IAEA officials. By May 2004, the IAEA was warning CPA officials that the facility had probably been looted (see May 2004).
More Unguarded Stockpiles - Iraq is dotted with unguarded stockpiles of explosives, say US military and administration officials. One senior administration official notes, “The only reason this stockpile was under seal is because it was located at Al Qaqaa,” where nuclear work had gone on years ago. [New York Times, 10/25/2004]
Oregon National Guardsman Sean Davis tells CBS’s 60 Minutes that his unit was not provided with enough ammunition when they were deployed to Iraq and that the guardsmen lacked night vision goggles and two-way radios. He explains they used walkie-talkies that they or their families purchased on their own. “And anybody can pick up those signals, you know,” he notes. [CBS News, 10/31/2004]
The Army completes a classified report on detainee abuse at Camp Nama, a Special Forces detention center at Baghdad International Airport. The report is based on an investigation led by Brigadier General Richard Formica into three specific allegations against the Combined Joint Special Operations Task Force Arabian Peninsula, which operates throughout Iraq. Formica’s report concludes that detainees who report being sodomized or beaten are seeking sympathy and better treatment, and thus are not credible. The report cites an Army medical report which had initially noted that a complaining detainee’s wounds were “consistent with the history [of abuse] he provided.… The doctor did find scars on his wrists and noted what he believed to be an anal fissure.” Two days later, Formica had the detainee re-examined by another doctor, who found “no fissure, and no scarring.” Formica concludes, “As a result, I did not find medical evidence of the sodomy.” In the case of a detainee who died in custody, Formica reports that the detainee suffered bruising to the “shoulders, chest, hip, and knees” but adds, “It is not unusual for detainees to have minor bruising, cuts, and scrapes.” A July 2006 report by Human Rights Watch will find evidence of “serious mistreatment” of detainees based on witness accounts of Special Forces interrogators and other US personnel. Formica will note in an e-mail: “I conducted a thorough investigation… and stand by my report.… [S]everal issues” he discovered “were corrected,” he will say. In the opening hours of the US assault on the Sunni stronghold of Fallujah (see November 8, 2004), Lieutenant Colonel Gary Brandl tells his troops: “The enemy has got a face. He’s called Satan. He’s in Fallujah and we’re going to destroy him.” [Guardian, 11/10/2005; Unger, 2007, pp. 325]
The Washington Post reports that several thousand shoulder-fired surface-to-air missiles (SAMs), once under the control of Saddam Hussein’s government, are now missing. Their disappearance prompts US military and intelligence analysts to dramatically increase their estimate of such weapons that are missing and may be in the hands of insurgents. US analysts report that as many as 4,000 SAMs are unaccounted for, raising the total of such missiles unaccounted for to around 6,000. Exact figures are uncertain. “We don’t have a good estimate,” says a senior defense official. “Some have put forward some figures, but there is none that the Defense Intelligence Agency has confidence in.” When the US invaded Iraq, it did not secure many weapons depots, and hundreds of thousands of tons of munitions were looted. Since then, some have undoubtedly been sold to terrorist organizations. It would be a relatively simple matter to use SAMs to shoot down military or commercial aircraft, and in several instances, insurgents have used such missiles to shoot down American military helicopters. [Source: Al Jazeera]The US military undertakes Operation Phantom Fury in an effort to retake the city of Fallujah from Sunni insurgents. During the more than two-week long offensive, Iraqi NGOs are prohibited from delivering humanitarian aid to residents of the besieged city. A representative for the Iraq Red Crescent Society (IRCS), Muhammad al-Nuri, will estimate that at least 6,000 Iraqis are killed in the offensive. The Iraqi government’s own studies will suggest that 70 percent of Fallujah’s buildings are destroyed by the fighting. [IRIN, 4/4/2004; Washington Post, 11/9/2004; IRIN, 11/26/2004] In the ensuing battle, the city’s water, power, and food supplies are completely cut, actions later condemned as violations of the Geneva Conventions by a UN special rapporteur, who accuses the US of “using hunger and deprivation of water as a weapon of war against the civilian population.” At least 200,000 civilians flee Fallujah, many ending up in squatters’ camps with no basic facilities. “My kids are hysterical with fear,” says one Iraqi father. “They are traumatized by the sound [of fighting] but there is nowhere to take them.” The US military bars the Red Cross, Red Crescent, and journalists from the area. All males between the ages of 15 and 55 are forced to stay in the city (see November 10, 2004). Over 100,000 civilians are trapped in the city during the US siege, forced to endure a pitched battle between US forces and between 600 and 6,000 insurgents.
US Targets Civilians - The city’s main hospital is the first target (see November 9, 2004), picked because, as the New York Times reports, “the US military believed it was the source of rumours about heavy casualties.” An AP photographer documents US helicopters killing a family of five trying to ford a river to safety. A Lebanese photographer will say, “There were American snipers on top of the hospital shooting everyone.” The photographer, Burhan Fasa’am, adds: “With no medical supplies, people died from their wounds. Everyone in the street was a target for the Americans.” Another Fallujah citizen will later recall: “I watched them roll over wounded people in the streets with tanks. This happened so many times.” A third citizen will later recall: “They shot women and old men in the streets. Then they shot anyone who tried to get their bodies.” US forces use incendiary weapons, including white phosphorus (see Mid-November 2004). When asked about the use of such controversial weaponry, Captain Erik Krivda explains, “Usually we keep the gloves on, [but] for this operation, we took the gloves off.” Just before the operation commences, a Marine commander tells his troops: “You will be held accountable for the facts not as they are in hindsight but as they appeared to you at the time. If, in your mind, you fire to protect yourself or your men, you are doing the right thing. It doesn’t matter if later on we find out you wiped out a family of unarmed civilians.” [Weinberger, 2005, pp. 63-64; Guardian, 11/10/2005]
Marine Casualties - The suffering and death are not one-sided. Lieutenant Commander Richard Jadick, a Navy doctor who volunteered to go to Iraq to help ease the shortage of doctors there, finds himself in the middle of pitched battles, doing his best to save Marines wounded in battle, many with horrific injuries. Lieutenant Colonel Mark Winn will estimate that without Jadick, his unit would have lost at least 30 more troops. Jadick will receive the Bronze Star with a Combat V for valor for his efforts. “I have never seen a doctor display the kind of courage and bravery that [Jadick] did during Fallujah,” Winn later recalls. [Newsweek, 3/20/2006]
Widespread Destruction - By the end of operations, around 36,000 of the city’s 50,000 homes are destroyed, along with 60 schools and 65 mosques and shrines. US casualty figures claim that about 2,000 Iraqis die in the fighting (Iraqi Prime Minister Iyad Allawi will claim that no civilians died in Fallujah), but Iraqi human rights organizations and medical workers claim the number is somewhere between 4,000 and 6,000. A Fallujah housewife will finally return to her home to find a message written in lipstick on her living room mirror: “F_ck Iraq and every Iraqi in it.” Mike Marquesee of the human rights organization Iraq Occupation Focus, will later write that the US and British media offers a “sanitized” version of events. “[C]ivilian suffering was minimized and the ethics and strategic logic of the attack largely unscrutinized,” Marquesee will observe. The siege is inconclusive at best: for the next year, Fallujah will remain essentially under lockdown, and heavy resistance and violence will spread to other cities, including Tal-Afar, Haditha, and Husaybah. [Weinberger, 2005, pp. 63-64; Guardian, 11/10/2005] Reporter Hala Jaber, the last reporter to leave Fallujah before the military assault begins and the first to return to that devastated city months later, will write over a year after Operation Phantom Fury: “The bitter truth is that the actions of US and Iraqi forces have reignited the insurgency. Anger, hate, and mistrust of America are deeper than ever.” [London Times, 12/18/2005]

Multiple sources claim that at 5:30 am on this day US warplanes drop three bombs on the Central Health Center in Fallujah, killing 35 patients and 15 health workers. The attack further incapacitates Fallujah’s medical infrastructure which is already degraded because of the US military’s takeover of the city’s main hospital and because the city’s water supply was cut off before the siege. [Nation, 11/24/2004]
A group of 225 Iraqis attempting to flee the US siege of Fallujah are stopped at the southern edge of the city by the US Marines’ 2nd Reconnaissance Battalion. The Marines permit 25 women and children to pass through, but send the remaining 200 men of military age back into the city. Fallujah has been under aerial and artillery bombardment since November 8. An officer explains to an Associated Press reporter, “There is nothing that distinguishes an insurgent from a civilian.” The US military wants to kill or capture as many insurgents as possible, and therefore does not want any escaping the city. “We assume they’ll go home and just wait out the storm or find a place that’s safe,” the officer says. The battalion has been ordered to tell Iraqi men, “Stay in your houses, stay away from windows and stay off the roof and you’ll live through Fallujah.” The US military also sinks boats that were being used to ferry people across the Euphrates River to safety. According to the US military, the boats were also used to transport weapons into the city. [Associated Press, 9/13/2004]
The New York Times reports on the Pentagon’s efforts to develop its own internet, or “war net,” which the Pentagon calls the Global Information Grid (GIG). The GIG would, among other things, allow soldiers to download high-resolution imagery of the places where they are fighting. The “essence of net-centric warfare is [the]… ability to deploy a war-fighting force anywhere, anytime,” says John Garing, strategic planning director at the Defense Information Security Agency, who is quoted in the article. The newspaper reports that “[a]dvocates say networked computers will be the most powerful weapon in the American arsenal” and that “fusing weapons, secret intelligence and soldiers in a global network… will…. change the military in the way the Internet has changed business and culture.” The article quotes several officials and people in private industry who are involved in GIG. For example, Robert J. Stevens, chief executive of the Lockheed Martin Corporation, says that the DoD’s objective is to provide troops in the field with a “a picture of the battle space, a God’s-eye view” which he says will give the military “real power.” Linton Wells II, director of the Office of Networks and Information Integration, says that net-centric principles (see July 27, 2001) are becoming “the center of gravity” for war planners and that the “tenets are broadly accepted throughout the Defense Department.” The article also reports that skeptics of the program doubt that the Pentagon will succeed in its project because it will require excessive amounts of bandwidth—enough to download “three feature-length movies a second.” The Times reports that the program has a projected cost of $120 billion—roughly 5 times the total cost, in today’s dollars, of the Manhattan project to build the atomic bomb. US forces use white phosphorus (WP) gas munitions as incendiary weapons against human targets during their seige of Fallujah, Iraq (see November 8, 2004). [Inter Press Service, 11/26/2003; Daily Telegraph, 11/9/2004; San Francisco Chronicle, 11/10/2004; Rainews24 (Italy), 11/2005] White phosphorus—also known as Willy Pete or Whiskey Pete—is used by the military for signaling, screening, and incendiary purposes. White phosphorus munitions, upon explosion, distribute particles over a wide swath of area. They burn spontaneously in the air and will continue to burn until all white phosphorus particles have disappeared. The smoke easily penetrates clothing and protective gear and can burn a person’s flesh to the bone. [Democracy Now!, 11/8/2005; GlobalSecurity (.org), 11/9/2005] According to Jeff Englehart, a US soldier involved in the seige of Fallujah, “Phosphorus burns bodies, in fact it melts the flesh all the way down to the bone.… Phosphorus explodes and forms a cloud. Anyone within a radius of 150 meters is done for.” [Independent, 11/8/2004]
Iraqi Witnesses Allege Use of Incendiary Weapons - “Poisonous gases have been used in Fallujah,” 35-year-old trader from Fallujah Abu Hammad tells reporter Dahr Jamail. “They used everything—tanks, artillery, infantry, poison gas. Fallujah has been bombed to the ground.” Another resident, Abu Sabah, from the Julan area, explains: “They used these weird bombs that put up smoke like a mushroom cloud. Then small pieces fall from the air with long tails of smoke behind them.” He says the pieces then explode into large fires that burn the skin even when water is applied. “People suffered so much from these,” he adds. [Inter Press Service, 11/26/2003] Corroborating their accounts, the San Francisco Chronicle reports that some “Insurgents reported being attacked with a substance that melted their skin, a reaction consistent with white phosphorous burns.” Kamal Hadeethi, a physician at a regional hospital, tells the newspaper, “The corpses of the mujahedeen which we received were burned, and some corpses were melted.” [San Francisco Chronicle, 11/10/2004]
Alternate Explanation - Lieutenant Colonel Steve Boylan, in November 2005, will deny that US troops used white phosphorus gas against people in Fallujah. “I know of no cases where people were deliberately targeted by the use of white phosphorus,” he tells Democracy Now. “White phosphorus is used for obscuration, which white phosphorus produces a heavy thick smoke to shield us or them from view so that they cannot see what we are doing. It is used to destroy equipment, to destroy buildings. That is what white phosphorus shells are used for.” He insists that the pictures showing melted corpses with clothing still intact is not proof of white phosphorus attacks. “That can happen from numerous ways and not just from white phosphorus attacks. That can happen from massive explosions. If you look at the car bombs that the terrorists use today, you have the same effects from car bombs from suicide vests. I have personally witnessed these things here in Baghdad.” [Democracy Now!, 11/8/2005]
Pentagon Confirms Use of White Phosphorus against 'Enemy Combatants' - The Pentagon, however, does not deny that the weapon was used against human targets. On November 14, 2005, spokesman Lieutenant Colonel Barry Venables says that white phosphorus was used to “fire at the enemy.” He adds: “It burns.… It’s an incendiary weapon. That is what it does.” [Independent, 11/15/2005] “It was used as an incendiary weapon against enemy combatants.” [BBC, 11/16/2005]
Against US Army Policy - In 1980, the Convention on Conventional Weapons banned the use of incendiary devices, like white phosphorous, in heavily populated areas. The United States was one of the few countries that refused to sign the agreement (see October 10, 1980-December 2, 1983). Even so, an instruction manual used by the US Army Command and General Staff School (CGSC) at Fort Leavenworth, Kansas states that “it is against the law of land warfare to employ WP against personnel targets.” [Independent, 11/19/2005]
First-Hand Accounts - There are a number of first-hand accounts of the battle, as well as video footage and photographs, suggesting the use of white phosphorus against human targets.
Jeff Englehart, who is in a tactical attack center about 200 meters from where a lot of the explosions that are happening [Democracy Now!, 11/8/2005] , later recalls: “I heard the order to pay attention because they were going to use white phosphorus on Fallujah. In military jargon it’s known as Willy Pete.… I saw the burned bodies of women and children.” [Rainews24 (Italy), 11/2005]
Photographs provided by the Studies Centre of Human Rights in Fallujah [Rainews24 (Italy), 11/2005] include numerous high-quality, color close-ups of bodies of Fallujah residents, some still in their beds, whose clothes remain largely intact but whose skin has been dissolved or caramelized by the shells. A documentary, titled Fallujah: The Hidden Massacre, broadcast on Italian news channel RAI a year after the assault shows helicopters launching white phosphorus munitions directly into the city. [Rainews24 (Italy), 11/2005] According to the RAI film, the US has attempted to destroy filmed evidence of the alleged use of white phosphorus on civilians in Falluja. A March 2005 US Army report written by three US artillery men who participated in the siege will confirm that white phosphorus was used against human targets during the siege. “WP proved to be an effective and versatile munition. We used it for screening missions at two breeches and, later in the fight, as a potent psychological weapon against the insurgents in trench lines and spider holes when we could not get effects on them with HE [High Explosive weapons]. We fired ‘shake and bake’ missions at the insurgents, using WP to flush them out and HE to take them out.” [Field Artillery, 3/2005 ; Independent, 11/15/2005]
CIA Director Porter Goss, known for being dogmatically loyal to the White House (see September 25, 2003 and November-December 2004), responds to the recent spate of leaked CIA memos (see September 16, 2004, September 28, 2004, and October 4, 2004) by issuing a memo reminding agency staff that they should “scrupulously honor our secrecy oath.” The memo is leaked to the press the next day. Goss says, “Intelligence-related issues have become the fodder of partisan food fights and turf-power skirmishes.” Goss warns that agency officials must publicly support Bush administration policies: “As agency employees we do not identify with, support or champion opposition to the administration or its policies,” Goss writes. His intention is, he writes, “to clarify beyond doubt the rules of the road.” Goss’s words may indicate that CIA employees must conform with administration policies and goals, but he also writes, “We provide the intelligence as we see it—and let the facts alone speak to the policymaker.” Many critics of the agency and its leadership say that Goss’s memo is part of his attempt to squelch dissent within the agency’s ranks. “If Goss is asking people to color their views and be a team player, that’s not what people at CIA signed up for,” says a former intelligence official. Ron Wyden (D-OR), a member of the Senate Intelligence Committee, says that “on issue after issue, there’s a real question about whether the country and the Congress are going to get an unvarnished picture of our intelligence situation at a critical time.” [New York Times, 11/17/2004; Roberts, 2008, pp. 153]
Rich creditor nations in the Paris Club announce they have reached a deal with the US on the proposed forgiveness of the $38.9 billion owed to those countries. The US wanted 95 percent of the debt canceled while the Paris Club was initially only willing to forgive 50 percent. Under the agreement, the Paris Club agrees to forgive 80 percent. Thirty percent of this will be forgiven immediately, followed by another 30 percent when Iraq agrees on a reform program with the International Monetary Fund, which it is expected to do in 2005. The remaining 20 percent will be canceled in 2008, after Iraq has implemented the reforms. The creditor countries owed the largest sums of money are Japan (4.1 billion dollars), France (2.9 billion), Germany (2.4 billion), the United States (2.2 billion), Britain (900 million), and Russia (9 billion). [St. Petersburg Times, 11/22/2004; Inter Press Service, 11/23/2004] The deal is denounced in a resolution passed by the Iraqi National Assembly on November 30. The resolution states that “the Paris Club has no right to make decisions and impose IMF conditions on Iraq.” It also says that nearly all of the debt is odious and should be canceled. New York Times foreign affairs columnist Thomas Friedman writes: “Improv time is over. This is crunch time. Iraq will be won or lost in the next few months. But it won’t be won with high rhetoric. It will be won on the ground in a war over the last mile.” Friedman will continue predicting a resolution of the Iraq situation in “the next six months” until at least May 2006 (see May 6-11, 2006). However, there is no official investigation until December 2004, after the widely publicized Abu Ghraib abuse scandal. Gen. Bantz Craddock, head of the US Army’s Southern Command and a close associate of Defense Secretary Donald Rumsfeld, assigns Air Force Lt. Gen. Randall Schmidt to investigate. Schmidt will later say, “I found some things that didn’t seem right. For lack of a camera, you could have seen in Guantanamo what was seen at Abu Ghraib.” Schmidt will say that he determined Maj. Gen. Geoffrey Miller, commander of the Guantanamo prison, “was responsible for the conduct of interrogations that I found to be abusive and degrading. The intent of those might have been to be abusive and degrading to get the information they needed.… Did the means justify the ends? That’s fine.… He was responsible.” Schmidt formally recommends that Miller be “held accountable” and “admonished.” But Craddock rejects this and absolves Miller of any improprieties, and the army’s Inspector General seconds that conclusion. By this time, Miller is in charge of reforming Abu Ghraib and other prisons in Iraq (see March 22, 2004). Schmidt will later learn that Rumsfeld was in contact with Miller about some Guantanamo interrogations and personally approved the most severe interrogation tactics. [New Yorker, 6/17/2007]
The chief of the CIA’s station in Baghdad, Iraq, leaves his post after the end of his one-year tour (see (January 2004)). According to Harper’s magazine, by the end of his tour he is a “pariah within the system” because he has filed a series of six pessimistic Aardwolf priority reports about the deteriorating situation in Iraq. One anonymous former intelligence official will say that the station chief is “treated like shit” and “farmed out,” although he is not fired. In addition, White House officials allegedly ask for “dirt” on him, including his political affiliation. [Harper's, 5/18/2006] After one of the pessimistic reports in late 2004, an official at the National Security Council even called US Ambassador to Iraq John Negroponte to ask whether the chief is a Democrat or Republican. [Risen, 2006] The station chief will also be investigated over allegations of detainee abuse (see (After January 2005)).

[Source: Public domain via the Department of Defense]During a visit by Defense Secretary Donald Rumsfeld to Camp Buerhing in Kuwait, Specialist Thomas Wilson asks Rumsfeld why soldiers have to improvise armor for themselves out of scrap metal. Wilson, a National Guardsman from Tennessee, is referring to so-called “hillbilly armor” or “hajj armor” (see March 2003 and After). He asks Rumsfeld, “Why do we soldiers have to dig through local landfills for pieces of scrap metal and compromised ballistic glass to up-armor our vehicles?” His question meets with shouts of approval and applause from the assembled 2,300 soldiers; an obviously discomfited Rumsfeld responds: “It isn’t a matter of money, it isn’t a matter on part of the Army of desire. It’s a matter of production and capability of doing it. As you know, you go to war with the Army you have.” Colonel John Zimmerman of the Tennessee National Guard says: “What we basically have is what we call hillbilly steel, hillbilly armor. It’s real frustrating for these soldiers.” Zimmerman says 95 percent of his unit’s 300 trucks do not have appropriate armor. Specialist Blaze Crook says he was appalled when he saw the condition of a vehicle he is slated to ride in. “It’s got huge windows on the front of my truck,” he says. “It’s basically like a window of opportunity to get shot, or shrapnel or anything like that to come through. It just doesn’t make me feel good that I’m riding up there without the proper armor.” Kurt Hendler, a reservist with the Navy’s Seabees construction force, says he and his colleagues are using steel plates intended for road repairs to retrofit trucks and Humvees with better armor. “We cover up the doors and put on some three-inch plate to protect the passenger and driver’s side from IED [improvised explosive device] attacks, sniper fire, and any other small-arms fire,” he says. [ABC News, 12/8/2004; Rich, 2006, pp. 156-157] White House press secretary Scott McClellan will later call Rumsfeld’s answer “a defining moment of his career—and not a positive one.” He will add, “[H]is comments helped solidify an already-accepted media narrative: the administration was sending troops that were ill equipped to fight the IED threat from terrorists and insurgents; worse still, administration officials were either unaware of the problems, unable to fix them, or totally unconcerned.” [McClellan, 2008, pp. 250] Wilson will come under scathing attack from right-wing commentators such as Rush Limbaugh when it is learned that he was given his question to ask by a reporter (see December 9, 2004).
Defense Secretary Donald Rumsfeld was put on the spot by a recent question from a US soldier in Kuwait about he and his fellow soldiers being forced to use scrap metal as so-called “hillbilly armor” for their vehicles (see December 8, 2004). The media now learns that the question, posed by Specialist Thomas Wilson, was given to Wilson by a newspaper reporter embedded with his unit, the 278th Regimental Combat Team, a Tennessee National Guard unit preparing for deployment in Iraq. Reporter Lee Pitts, of the Chattanooga Times Free Press, tells colleauges in an e-mail that he wanted to ask the question himself but was denied a chance to speak to Rumsfeld at the so-called “Pentagon town hall meeting.” Instead, Pitts says, he asked Wilson to pose the question. Pitts says he has been trying for weeks without success to “get this story out.” “I just had one of my best days as a journalist today,” Pitts writes. He says that when he learned that only soldiers would be allowed to ask Rumsfeld questions, he talked with Wilson and another soldier, and they “worked on questions to ask Rumsfeld about the appalling lack of armor their vehicles going into combat have.” Pitts says he “found the sergeant in charge of the microphone for the question and answer session and made sure he knew to get my guys out of the crowd.” Pitts writes that when Wilson asked his question, “the place erupted in cheers so loud that Rumsfeld had to ask the guy to repeat his question.” Rumsfeld’s apparently callous response—“you go to war with the army you have”—has caused a flurry of outraged responses (see December 15, 2004). Meanwhile, Wilson is weathering intense criticism for his question from some right-wing pundits and commentators. Talk show host Rush Limbaugh accuses him of “near insubordination” for daring to ask Rumsfeld such a pointed question. The New York Post claims that Wilson and Pitts “set up” Rumsfeld with the question. (Rumsfeld himself will compliment a later question about “negative press coverage” as obviously “not being planted by the media.”) Even though President Bush says he doesn’t blame Wilson for asking the question—“If I were a soldier overseas wanting to defend my country, I would want to ask the secretary of defense the same question”—Limbaugh and others are joined by Pentagon spokesman Lawrence Di Rita in criticizing Wilson and Pitts. “Town hall meetings are intended for soldiers to have dialogue with the secretary of defense,” Di Rita says. “The secretary provides ample opportunity for interaction with the press. It is better that others not infringe on the troops’ opportunity to interact with superiors in the chain of command.” [Poynter Online, 12/9/2004; CNN, 12/10/2004; Rich, 2006, pp. 156-157] Author and media critic Frank Rich will later write that the subject of Wilson’s question is not news at all; news reports of troops being sent into Iraq with broken weapons and damaged vehicles have circulated throughout the print media for well over a year. What is newsworthy, Rich will write, is that a soldier publicly called Rumsfeld out on the policy of sending troops into combat with substandard equipment. Also newsworthy is the fact that Rumsfeld’s claim that the only thing standing in the way of all soldiers receiving adequate equipment is “production and capability” is a lie. Manufacturers of vehicle armor, weapons, and other essential equipment say that they could easily increase production if the Pentagon were to ask them to do so. [Rich, 2006, pp. 157]
Neoconservative commentator William Kristol does not join other conservatives in lambasting Specialist Thomas Wilson for asking Defense Secretary Donald Rumsfeld an uncomfortable question about inadequate body armor (see December 8, 2004 and December 9, 2004). Instead, Kristol excoriates Rumsfeld for his apparently flippant response, “You go to war with the army you have.” The Army has “performed a lot better in this war than the secretary of defense has,” Kristol writes, but, he continues, “Rumsfeld is not the defense secretary [President] Bush should want to have for the remainder of his second term.” He calls Rumsfeld’s response “arrogant buck-passing” and slams Rumsfeld for his apparant callousness, quoting the secretary as telling the troops: “[I]f you think about it, you can have all the armor in the world on a tank and a tank can be blown up. And you can have an up-armored humvee and it can be blown up.” Kristol retorts sarcastically: “Good point. Why have armor at all? Incidentally, can you imagine if John Kerry had made such a statement a couple of months ago? It would have been (rightly) a topic of scorn and derision among my fellow conservatives, and not just among conservatives.” Rumsfeld has not performed well since the war began, Kristol writes, constantly resisting calls to increase troop numbers and then unfairly blaming field commanders such as General Tommy Franks and General John Abizaid for not requesting more troops. “All defense secretaries in wartime have, needless to say, made misjudgments,” Kristol writes. “Some have stubbornly persisted in their misjudgments. But have any so breezily dodged responsibility and so glibly passed the buck?” He concludes, “These soldiers deserve a better defense secretary than the one we have.” [Washington Post, 12/15/2005]
Top Iraqi officials head to Washington for the second meeting of the Iraq-US Joint Economic Commission. The first meeting took place in September. At a press conference, Iraqi Finance Minister Adil Abdel Mahdi tells reporters that the new Iraqi government is implementing, or intends to implement, a number of major changes to the country’s economy. Some of the reforms he mentions would be part of a new oil law that will be “open to investment, to foreign investment downstream, maybe even upstream.” He explains that the law is being developed by a “high-ranked official from the Oil Ministry” in consultation with “his counterparts and with agencies here in the States.” Mahdi also says that Iraq will review the oil contracts that Saddam Hussein had inked with countries like France and Russia. “So I think this is very promising to the American investors and to American enterprises, certainly to oil companies,” he says. Mahdi also defends an agreement the Iraqi government recently made with the IMF to implement certain reforms, which included an end to food subsidies (see September 29, 2004). “I think this is a necessity for the Iraqi economy,” Mahdi says. “We really need to work on our subsidy side. Subsidies are taking almost 60 percent of our budget. So this is something we have to work on… Other measures really were a real necessity for the Iraqi economy before becoming conditions asked by the IMF.” But as Inter Press Service notes, Iraq’s food subsidies system “have kept millions of Iraqis from starvation under US and UK-pressed sanctions imposed by the United Nations after the 1991 Gulf War.… It is believed that many more Iraqis would have died if not for Hussein’s strong subsidies system that gave food to Iraqi families.” An issue that is apparently not discussed during the two-day meeting between US and Iraqi officials is the large amount of money that is known to have been defrauded from the CPA. In response to a reporter’s question, Mahdi says only, “No, this issue has not been discussed. We are interested to follow such issues, of course. [Source: Omnitec Solutions]Since the Pentagon began using retired military officers as media “military analysts” to promote the Iraq war and occupation (see April 20, 2008 and Early 2002 and Beyond), it has closely monitored the performance of those analysts. Among other methods, it retains the services of a private contractor, Omnitec Solutions, to scour databases for any mention of military analysts in the broadcast and print media. Omnitec uses the same tools as corporate branding experts to tabulate and evaluate the performance of those analysts. One Omnitec report, issued this year, assesses the impact of the analysts in the media after they were given a carefully programmed “tour” of Iraq by the Pentagon. According to the report, upon their return, the analysts echoed Pentagon themes and talking points throughout the media. “Commentary from all three Iraq trips was extremely positive over all,” the report concludes. According to Senator Jay Rockefeller (D-WV), Vice President Dick Cheney applies “constant” pressure on Senator Pat Roberts (R-Kan) to stall the inquiry that is looking into the Bush administration’s use of flawed intelligence on Iraq. The investigation, known as the Phase II investigation, was supposed to have been completed shortly after the Senate Select Committee on Intelligence finished the first phase in July 2004. Cheney’s office denies that the vice president tried to influence the pace of the investigation in anyway. [McClatchy News, 1/25/2006]
Ariel Cohen, who co-authored a September 2002 paper (see September 25, 2002) recommending the privatization of Iraq’s oil industry, explains to reporter Greg Palast how his privatization plan would have ended OPEC’s control over oil prices. He says that if Iraq’s fields had been sold off, competing companies would have quickly increased the production of their individual patches, resulting in over production which would have flooded world oil markets, thrown OPEC into panic, and destabilized the Saudi monarchy. In an interview with Greg Palast, Robert Ebel, a former Department of Energy and and CIA oil analyst, acknowledges that the invasion of Iraq was driven by oil interests. “The thought was, ‘Why are you going into Iraq? It’s about oil isn’t it?’ And my response was, ‘No, It’s about getting rid of Saddam Hussein. The morning after, it’s about oil.’” [Democracy Now!, 3/21/2005]
The US sends teams of US-trained former Iranian exiles, sometimes accompanied by US Special Forces, from Iraq into southern and eastern Iran to search for underground nuclear installations. [New Yorker, 1/24/2005; United Press International, 1/26/2005; Guardian, 1/29/2005] In the north, Israeli-trained Kurds from northern Iraq, occasionally assisted by US forces, look for signs of nuclear activity as well. [United Press International, 1/26/2005] Both teams are tasked with planting remote detection devices, known as “sniffers,” which can sense radioactive emissions and other indicators of nuclear-enrichment programs while also helping US war planners establish targets. [New Yorker, 1/24/2005; United Press International, 1/26/2005] The former Iranian exiles operating in the south and east are members of Mujahedeen-e Khalq (MEK), a group that has been included in the State Department’s list of foreign terrorist organizations since 1997 (see 1997) and included in a government white paper (see September 12, 2002) that criticized Iraq for its support of the group. After the US invaded Iraq, members of MEK were “consolidated, detained, disarmed, and screened for any past terrorist acts” by the US (see July 2004) and designated as “protected persons.” (see July 21, 2004) Initially, the MEK operate from Camp Habib in Basra, but they later launch their incursions from the Baluchi region in Pakistan. [United Press International, 1/26/2005; Newsweek, 2/15/2005] They are assisted by information from Pakistani scientists and technicians who have knowledge of Iran’s nuclear program. [New Yorker, 1/24/2005] Pakistan apparently agreed to cooperate with the US in exchange for assurances that Pakistan would not have to turn over A. Q. Khan, the so-called “father of Pakistan’s nuclear bomb,” to the IAEA or to any other international authorities for questioning. Khan, who is “linked to a vast consortium of nuclear black-market activities,” could potentially be of great assistance to these agencies in their efforts to undermine nuclear weapons proliferation. [New Yorker, 1/24/2005] In addition to allowing Pakistan to keep Khan, the US looks the other way as Pakistan continues to buy parts for its nuclear-weapons arsenal in the black market, according to a former high-level Pakistani diplomat interviewed by Seymour Hersh [New Yorker, 1/24/2005] The United States’ use of MEK is criticized by Western diplomats and analysts who agree with many Iranians who consider the group to be traitors because they fought alongside Iraqi troops against Iran in the 1980s. At a conference with oil companies in Beirut, the British ambassador in Baghdad gives the Iraqi finance minister a report (see Autumn 2004) authored by the International Tax and Investment Centre, a Washington-based oil industry lobby. The report, which contains recommendations for a new Iraqi oil policy, expresses the view that Iraq’s relationships with oil companies should be governed through the use of production sharing agreements (PSAs). [Observer, 3/4/2007]
A Farsi-speaking former CIA officer says he was approached by neoconservatives in the Pentagon who asked him to go to Iran and oversee “MEK [Mujahedeen-e Khalq] cross-border operations” into Iran, which he refused to do. Commenting on the neoconservatives’ ambitions in Iran, the former officer says, “They are bringing a lot of the old war-horses from the Reagan and Iran-contra days into a sort of kitchen cabinet outside the government to write up policy papers on Iran.” He says their plans for Iran are “delusional.” “They think in Iran you can just go in and hit the facilities and destabilize the government. They believe they can get rid of a few crazy mullahs and bring in the young guys who like Gap jeans, all the world’s problems are solved,” he says. [Guardian, 1/18/2005] Journalist Craig Unger explains the neoconservatives’ willingness to rely on MEK fighters. For them, Unger writes, MEK is not a terrorist group, but “America’s best hope in Iran.” [Vanity Fair, 3/2007]
A new chief of the CIA’s Baghdad station is appointed. Possibly due to problems the previous two station chiefs are perceived to have experienced (see (Late December 2003) and December 2004), this new official files only one Aardwolf priority report during his one-year tour. An anonymous official will later say that this report is widely derided within the CIA as “a joke,” because it asserts that the United States is winning the war despite all evidence to the contrary. Harper’s journalist Ken Silverstein will comment, “It was garbage, but garbage that the Bush administration wanted to hear.” At the end of his tour, the station chief will be given what Silverstein calls a “plum assignment.” [Harper's, 5/18/2006]
Ben Carter, an employee for Halliburton subsidiary Kellogg, Brown, & Root (KBR), serves as the foreman of the water purification unit at Camp Ar Ramadi, a US military base also known as “Junction City.” At the base, both potable and non-potable water is supplied for different purposes. Non-potable water, despite not being used for drinking, is expected to meet certain safety standards so that US troops can use it for bathing, showering, shaving, laundry, and cleaning. After another KBR employee discovers larvae swimming in a toilet bowl, Carter does a test and discovers that there is no chlorine present in the non-potable water. When he tests the non-potable water tank, he is shocked to find out that “the water in the tank tested negative for chlorine; that the access lid of the tank was not in place, let alone secure, and the air vents to the tank were turned upward and left unscreened; leaving the water supply vulnerable to contamination from dust, insects, rodents or even enemy attack.” He reports his findings and urges the military to chlorinate their water tanks. But he is told by the KBR site commander that the water is not his concern. Carter is frequently hindered by higher-ups in his attempts to make sure that the water is properly purified and eventually leaves Iraq in frustration. Arlen Specter. [Source: US Senate]White House counsel Alberto Gonzales testifies before the US Senate as part of his confirmation as the Bush administration’s new attorney general. Much of the seven hours of testimony focuses on Gonzales’s position on torturing terrorist suspects. He is specifically questioned on the August 2002 Justice Department memo requested by Gonzales that outlined how US officials could interrogate subjects without violating domestic and international laws against torture by setting unusually high standards for the definition of torture (see August 1, 2002). [Democracy Now!, 1/7/2005] Arlen Specter (R-PA) asks Gonzales if he approves of torture. Gonzales replies, “Absolutely not,” but refuses to be pinned down on specifics of exactly what constitutes torture.
Equivocating on the Definition of Torture - Gonzales says he “was sickened and outraged” by the photographs of tortured Iraqis at Abu Ghraib prison (see Evening November 7, 2003), but refuses to say whether he believes any of that conduct is criminal, citing ongoing prosecutions. Joseph Biden (D-DE) retorts: “That’s malarkey. You are obliged to comment. That’s your judgment we’re looking at.… We’re looking for candor.” [CNN, 1/7/2005] When asked whether he agrees with the August 2002 memo that said, “[F]or an act to violate the torture statute, it must be equivalent in intensity to the pain accompanying serious physical injury such as organ failure, impairment of bodily function, or even death,” Gonzales says: “We were trying to interpret the standard set by Congress. There was discussion between the White House and Department of Justice as well as other agencies about what does this statute mean? It was a very, very difficult—I don’t recall today whether or not I was in agreement with all of the analysis, but I don’t have a disagreement with the conclusions then reached by the department.” He says that the standard “does not represent the position of the executive branch” today. Author and torture expert Mark Danner calls the standard “appalling… even worse the second time through.” Gonzales was obviously prepped for this line of questioning, Danner says: “He sat in front of the committee and asserted things, frankly, that we know not to be true.… He was essentially unwilling to say definitively there were no situations in which Americans could legally torture prisoners.… [T]here’s an assumption behind [this performance] that we have the votes. We’re going to get through. I just have to give them nothing on which to hang some sort of a contrary argument.”
Equivicating on Techniques - Edward Kennedy (D-MA) questions Gonzales about what techniques are defined as torture, including “live burial” (see February 4-5, 2004) and waterboarding. Kennedy says that, according to media reports, Gonzales never objected to these or other techniques. Gonzales does not have a “specific recollection” of the discussions or whether the CIA ever asked him to help define what is and is not torture. He also says that in “this new kind of” war against “this new kind of enemy, we realized there was a premium on receiving information” the US needs to defeat terrorists. Agencies such as the CIA requested guidance as to “[w]hat is lawful conduct” because they did not “want to do anything that violates the law.” Kennedy asks if Gonzales ever suggested that the Justice Department’s Office of Legal Counsel (OLC) ever “lean forward on this issue about supporting the extreme uses of torture?” Gonzales focuses on Kennedy’s phrasing: “Sir, I don’t recall ever using the term sort of ‘leaning forward,’ in terms of stretching what the law is.” He refuses to admit giving any opinions or requesting any documents, but only wanted “to understand [the OLC’s] views about the interpretation” of torture. Danner notes that Justice Department officials have told reporters that Gonzales pushed for the expansive definition of torture in the memos, but Gonzales refuses to admit to any of that in the questioning.
Ignoring the Uniform Code of Military Justice - Lindsey Graham (R-SC) tells Gonzales that the Justice Department memo was “entirely wrong in its focus” because it excluded the Uniform Code Of Military Justice, and that it “put our troops at jeopardy.” Gonzales replies that he does not think that because of the memo the US has lost “the moral high ground” in the world. Danner says, “[Graham] is arguing that these steps weakened the United States, not only by putting troops at risk, but by undermining the US’s reputation in the world, undermining the ideological side of this war… Graham is saying very directly that by torturing, and by supplying images like that one, of… a hooded man, the man with the hood over his head and the wires coming out of his fingers and his genitals which is known far and wide in the Arab world in the Middle East it’s become highly recognizable by supplying that sort of ammunition, you’re giving very, very strong comfort and aid to the enemy in fact.” [Democracy Now!, 1/7/2005]

Newsweek reports that the Pentagon is considering a new approach to dealing with the insurgency in Iraq, one defense officials call the “Salvador Option.” During the 1980s, the US, primarily through the CIA, funded and supported paramilitary units, often called “death squads” by the citizenry and various human rights organizations which monitored their activities, in El Salvador and other Central American nations. These death squads carried out numerous assassinations and kidnappings, including the murder of four American nuns in 1980. Many US conservatives consider the Salvadoran operation a success, though many innocent Salvadorans died, some under torture, and the operation fomented the US government policies that became known collective as “Iran-Contra.” Now the Pentagon is debating whether the same tactics should be used in Iraq. “What everyone agrees is that we can’t just go on as we are,” says a senior military official. “We have to find a way to take the offensive against the insurgents. Right now, we are playing defense. And we are losing.” Another military source contends that Iraqis who sympathize with the insurgents need to be targeted: “The Sunni population is paying no price for the support it is giving to the terrorists. From their point of view, it is cost-free. We have to change that equation.” One proposal would “send [US] Special Forces teams to advise, support and possibly train Iraqi squads, most likely hand-picked Kurdish Peshmerga fighters and Shiite militiamen, to target Sunni insurgents and their sympathizers, even across the border into Syria.” Among the proposal’s supporters is Iraqi Prime Minister Iyad Allawi and Defense Secretary Donald Rumsfeld. But other Pentagon officials are shy of running any operation that might contravene the Uniform Code of Military Justice, and prefer the CIA to run the proposed operation. And many lawmakers, Pentagon officials, and military experts are wary of expanding the role of US Special Forces operations in such a legally and morally dubious direction. They also worry about the ramifications of using Iraqi Kurds and Shi’ite militia members against Iraqi Sunnis in potential death squads, characterized by investigative reporter Robert Parry as “a prescription for civil war or genocide.” Some speculate that this operation might be one of the reasons John Negroponte was recently named US ambassador to Iraq. Negroponte served as US ambassador to Honduras during the 1980s, and many feel Negroponte was a key figure in the establishment and operations of the Central American death squads. Other Bush officials active in the Central America program include Elliott Abrams, who oversaw Central American policies at the State Department and who is now a Middle East adviser on Bush’s National Security Council staff, and Vice President Dick Cheney, who was a powerful defender of the Central American policies as a member of the House of Representatives. Negroponte denies any involvement in any such program operating in Iraq. [Newsweek, 1/8/2005; Consortium News, 1/11/2005] Christopher Dickey, a Newsweek reporter with personal experience in El Salvador during the time of the death squads, writes that he is “prepared to admit that building friendly democracies sometimes has to be a cold-blooded business in the shadowland of moral grays that is the real world,” but says that the idea of US-formed death squads in Iraq, and the corollary idea of sending US Special Forces teams into Syria and perhaps other Middle Eastern countries is not only potentially a mistake, but one that is little more than “a formalization of what’s already taking place.” Former Defense Intelligence Agency analyst and Middle East specialist Patrick Lang says, “We are, of course, already targeting enemy cadres for elimination whether by capture or death in various places including Afghanistan and Iraq.” So many Special Forces personnel are already involved in such operations, Lang says, that there is an actual shortage of Green Berets to perform their primary task: training regular Iraqi troops. The operation could benefit the US presence in two ways: helping win the hearts and minds of the ordinary citizenry by successfully eliminating insurgents, or just by making the citizenry “more frightened of [the US] than they are of the insurgents.” [Newsweek, 1/11/2005]

The US television news media virtually ignores the court-martial of Specialist Charles Graner, who is charged with abusing and torturing prisoners at Abu Ghraib (see May 19, 2004-March 22, 2006 and January 16, 2005), according to author and media critic Frank Rich. “[I]f a story isn’t on TV in America, it’s MIA in the culture,” Rich will write. Much of the broadcast coverage is focused on stories about President Bush’s upcoming inauguration and on Britain’s Prince Harry, who had dressed up in Nazi regalia for a costume party. The network and cable news stations grant Graner’s trial only “brief, mechanical” summations “when it was broadcast at all.” The usual claims that television news only focuses on lurid, scandal-ridden news stories do not apply here, Rich writes: “It surely didn’t lack for drama; the Graner trial was Judgment at Nuremberg turned upside down.” Viewers do not learn of defense lawyer Guy Womack’s claim during his closing argument that “In Nuremberg, it was the government being prosecuted. We were going after the order-givers. Here the government is going after the order-takers.” Rich will later write that if the American public could not be exposed to fictional films about World War II (see November 11, 2004), then it “certainly… could not be exposed to real-life stories involving forced group masturbation, electric shock, rape committed with a phosphorescent stick, the burning of cigarettes in prisoners’ ears, involuntary enemas, and beatings that ended in death (see May 3-11, 2004). When one detainee witness at the Graner trial testified… that he had been forced to eat out of a toilet, his story was routinely cited in newspaper accounts but left unmentioned on network TV newscasts.” [Rich, 2006, pp. 155]
The National Intelligence Council, the center for midterm and long-term strategic thinking within the US intelligence community, issues a report concluding, “Iraq has replaced Afghanistan as the training ground for the next generation of ‘professionalized’ terrorists.” [Washington Post, 1/15/2005] In May, the CIA will report that Iraq may prove to be an even more effective training ground for Islamic extremists than Afghanistan was in al-Qaeda’s early days, because it is serving as a real-world laboratory for urban combat. The memo reports on Merritt’s conclusions and proposals in the aftermath of a Pentagon-sponsored trip to Iraq by a number of military analysts. The trip is part of the Pentagon’s propaganda operation, which uses retired military officers to go on broadcast news shows and promote the administration’s Iraq policies (see April 20, 2008 and Early 2002 and Beyond). The memo is in several sections:
'Background' - “One of the most interesting things coming from this trip to Iraq with the media analysts has been learning how their jobs have been undergoing a metamorphosis. There are several reasons behind the morph… with an all voluntary military, no one in the media has current military background. Additionally we have been doing a good job of keeping these guys informed so they have ready answers when the networks come calling.”
'Current Issues' - “The key issue here is that more and more, media analysts are having a greater impact on the television media network coverage of military issues. They have now become the go to guys not only for breaking stories, but they influence the views on issues. They also have a huge amount of influence on what stories the network decides to cover proactively with regard to the military…”
'Recommendation' - “1.) I recommend we develop a core group from within our media analyst list of those that we can count on to carry our water. They become part of a ‘hot list’ of those that we immediately make calls to or put on an email distro [distribution] list before we contact or respond to media on hot issues. We can also do more proactive engagement with this list and give them tips on what stories to focus on and give them heads up on issues as they are developing. By providing them with key and valuable information, they become the key go to guys for the networks and it begins to weed out the less reliably friendly analysts by the networks themselves…
3.) Media ops and outreach can work on a plan to maximize use of the analysts and figure out a system by which we keep our most reliably friendly analysts plugged in on everything from crisis response to future plans. This trusted core group will be more than willing to work closely with us because we are their bread and butter and the more they know, the more valuable they are to the networks…
5.) As evidenced by this analyst trip to Iraq, the synergy of outreach shops and media ops working together on these types of projects is enormous and effective. Will continue to exam [sic] ways to improve processes.”
Response from Di Rita - Di Rita is impressed. He replies, “This is a thoughtful note… I think it makes a lot of sense to do as you suggest and I guess I thought we were already doing a lot of this in terms of quick contact, etc… We ought to be doing this, though, and we should not make the list too small…” In 2008, Salon commentator Glenn Greenwald will sum up the plan: “So the Pentagon would maintain a team of ‘military analysts’ who reliably ‘carry their water—yet who were presented as independent analysts by the television and cable networks. By feeding only those pro-government sources key information and giving them access—even before responding to the press—only those handpicked analysts would be valuable to the networks, and that, in turn, would ensure that only pro-government sources were heard from. Meanwhile, the ‘less reliably friendly’ ones—frozen out by the Pentagon—would be ‘weeded out’ by the networks (see May 10-11, 2007). The pro-government military analysts would do what they were told because the Pentagon was ‘their bread and butter.’ These Pentagon-controlled analysts were used by the networks not only to comment on military matters—and to do so almost always unchallenged—but also even to shape and mold the networks’ coverage choices.” [Salon, 5/10/2008]
Army Specialist Charles Graner is sentenced to 10 years in prison. In a military court-martial, Graner was convicted of crimes related to the torture and abuse of prisoners in Baghdad’s Abu Ghraib prison (see October 2003), October 17-22, 2003), November 4-December 2, 2003, and (7:00 a.m.) November 4, 2003), including charges of battery, conspiracy, maltreatment of detainees, committing indecent acts, and dereliction of duty. Graner admitted some of his actions were criminal, and told jurors, “I didn’t enjoy what I did there” before he was found guilty. Asked if he felt remorse over his actions, Graner says simply: “There’s a war on. Bad things happen.” After Graner completes his sentence, he will be dishonorably discharged. He has forfeited all of his pay and benefits. Defense lawyer Guy Womack says that Graner and his six fellow Abu Ghraib guards also facing trials (see May 19, 2004-March 22, 2006) are being used as scapegoats by the Defense Department. Graner and his lawyers were unable to effectively discuss orders being handed down from superior officers during the trial, as the judge in the court-martial, Colonel James Pohl, refused to let witnesses say the names of officers who gave the orders or what orders might have been given, in effect constraining the trial to point to Graner and his colleagues as independent, “rogue” agents operating outside the chain of command. Graner did not testify during his trial, but during sentencing said that he had done what he was ordered to do by US intelligence agents, in order to “soften up” prisoners for interrogation. According to Graner, a lieutenant in his unit told him: “If [military intelligence] asks you to do this, it needs to be done. They’re in charge, follow their orders.” He believed the orders to torture and abuse prisoners were lawful, he claims. [Associated Press, 1/16/2005; Rich, 2006, pp. 155] Author and media critic Frank Rich will later note that while the print media coverage of Graner’s trial is relatively extensive, the broadcast media virtually ignores it in favor of celebrating the inauguration of President Bush (see January 11-16, 2005). [Source: Montgomery College]Chris Matthews, the host of MSNBC’s Hardball, asks three of the Pentagon’s most reliable “military analysts” (see April 20, 2008 and Early 2002 and Beyond)—retired generals Montgomery Meigs, Wayne Downing, and Kenneth Allard—on his show to pillory a recent New Yorker article by Seymour Hersh that reveals Pentagon plans for an attack on Iran (see (Early January 2005)). Matthews calls the three “Hardball’s war council.” After the broadcast, Allard writes an e-mail to Pentagon public relations official Larry Di Rita, in which he says, “As you may have seen on MSNBC, I attributed a lot of what [Hersh] said to disgruntled CIA employees who simply should be taken out and shot.” [Salon, 5/10/2008]

[White House, 1/20/2005] Author and media critic Frank Rich will observe that Bush’s inauguration is a four-day, $40 million media extravaganza designed to “enhance the White House’s portrayal of the war in Iraq.” The official theme is “Celebrating Freedom, Honoring Service.” Rich will write, “The trick for its production was to market the military effort while keeping all of its costs off-screen so that no unpleasantness or difficult questions… might spoil the party or Bush’s message of victory around the corner.” The ceremonies are ostensibly to honor the military men and women who have served the country, and are still serving, but during his inaugural address, Bush never says the word “Iraq.” The word is hardly mentioned at the lavish ball thrown for Bush’s Christian supporters at Washington’s Ritz-Carlton hotel. And the press, especially the network and cable outlets, cooperates, running breathless takes on the sumptuous festivities; Rich will write, “Television’s ceremonial coverage of the inauguration, much of which resembled the martial pageantry broadcast by state-owned networks in banana republics, dutifully parroted the White House message that the four-day bacchanal was a salute to the troops.” One of the few dissenters, Vanity Fair writer Judy Bachrach, observes on Fox News that the military ball and prayer service will not keep troops “safe and warm” in their “flimsy” Humvees in Iraq; after a commercial break, Bachrach is no longer on set. One particular “salute to the troops,” the “Heroes Red, White, and Blue Inaugural Ball,” is not televised, and rightly so, Rich will write, calling it “surreal.” Attendees include Defense Secretary Donald Rumsfeld and his deputy, Paul Wolfowitz, and Fox News commentator Geraldo Rivera, who jokingly equates his status as “overpaid” reporter with “underpaid hero[es]” in battle. (The audience, largely made up of injured soldiers from Walter Reed Army Medical Center and Bethesda Naval Hospital, respond to Rivera’s humor with “deafening silence,” according to one Washington Post report.) Rich points out the irony of the evening’s main entertainment act, Nile Rodgers and Chic, who “sang the lyrics ‘Clap your hands, hoo!’ and ‘Dance to the beat’ to soldiers who had lost hands and legs.” [Rich, 2006, pp. 159-160]
Stuart W. Bowen. [Source: PBS]A report completed by Stuart W. Bowen, the Special Inspector General for Iraq Reconstruction, finds that $8.8 billion of the $20 billion in Iraqi funds that the Coalition Provisional Authority spent between April 16, 2003 and June 28, 2004 is unaccounted for because of inefficiencies and bad management. “Severe inefficiencies and poor management” by the Coalition Provisional Authority has “left auditors with no guarantee the money was properly used,” the report says. The reports says that in once case, it’s possible that thousands of “ghost employees” were on an unnamed ministry’s payroll. “CPA staff identified at one ministry that although 8,206 guards were on the payroll, only 602 guards could be validated,” the audit report states. “Consequently, there was no assurance funds were not provided for ghost employees.” [Special Inspector General for Iraq Reconstruction, 1/30/2005, pp. 16 ; CNN, 1/31/2005] Two years after the release of this report, the inspector general will tell Congressman Henry Waxman (D-Ca) that the $8.8 billion figure was in fact too low because his investigation was limited to funds disbursed to Iraqi ministries between October 2003 and June 24, 2004. Bowen will tell Waxman that he believes that the lack of accountability and transparency actually extended to the entire $20 billion spent by the CPA. [US Congress, 2/6/2007, pp. 16 ]

[Source: Agence France-Presse]Elections for Iraq’s 275-member national assembly are held, the first democratic elections in Iraq in 50 years. Fifty-eight percent of Iraqis go to the polls to vote for a new government, the first national elections since Saddam Hussein’s overthrow. Iraqis proudly display their ink-dipped purple fingers as signs that they voted. In Washington, Republicans display their own enpurpled fingers as a sign of solidarity with President Bush and as a symbol of their pride in bringing democracy to Iraq. The Shi’ite-dominated United Iraqi Alliance (UIA) wins 48.2 percent of the vote, a coalition of two major Kurdish parties garners 25.7 percent, and a bloc led by interim Prime Minister Iyad Allawi wins only 13.8 percent. As expected, the Sunni parties capture only a fraction of the vote. [Washington Post, 2/14/2005; Unger, 2007, pp. 327-329]
Shi'ite Turnout High, but Election Marred by Violence - Suicide bombers and mortar attacks attempt to disrupt the elections, killing 44 around the country, but voters turn out in large numbers regardless of the danger. Three cloaked women going to polls in Baghdad tell a reporter in unison, “We have no fear.” Another Iraqi tells a reporter: “I am doing this because I love my country and I love the sons of my nation. We are Arabs, we are not scared and we are not cowards.” [Associated Press, 1/31/2005]
Sunni Boycott Undermines Legitimacy of Election Results - The political reality of the vote is less reassuring. Millions of Shi’ites do indeed flock to the polls, but most Sunnis, angered by years of what they consider oppression by US occupying forces, refuse to vote. Brent Scowcroft, the former foreign policy adviser held in such contempt by the administration’s neoconservatives (see October 2004), had warned that the election could well deepen the rift between Sunnis and Shi’a, and indeed could precipitate a civil war. Soon after the elections, Sunni insurgents will shift their targets and begin attacking Shi’ite citizens instead of battling US troops. Another popular, and effective, target will be Iraq’s decaying oil production infrastructure.
UIA Links to Iran and Terrorism Undermine US Ambitions - Another troublesome consequence of the elections is that Bush officials are forced to support a Shi’ite government led by Prime Minister Ibrahim al-Jaafari, a member of the Dawa Party, one of the two Shi’ite factions comprising the United Iraq Alliance. Dawa is so closely aligned with Iran that not only had it supported Iran in the Iraq-Iran War, but it had moved its headquarters to Tehran in 1979. While in the Iranian capital, Dawa had spun off what Middle East expert Juan Cole called “a shadowy set of special ops units generically called ‘Islamic Jihad,’ which operated in places like Kuwait and Lebanon.” Dawa was also an integral part of the process that created the Shi’ite terrorist group Hezbollah. And Dawa was founded by Muhammed Baqir al-Sadr, the uncle of radical Shi’ite cleric Moqtada al-Sadr, whose Mahdi Army has been accused of attempting to exterminate Sunni populations. In other words, the US is now supporting a government which not only supports terrorism, but itself incorporates a terrorist-affiliated organization in its executive structure. Author Craig Unger will write: “One by one the contradictions behind America’s Middle East policies emerged—and with them, the enormity of its catastrophic blunder. Gradually America’s real agenda was coming to light—not its stated agenda to rid Iraq of WMDs, which had been nonexistent, not regime change, which had already been accomplished, but the neoconservative dream of ‘democratizing’ the region by installing pro-West, pro-Israeli governments led by the likes of Ahmed Chalabi in oil-rich Middle East states. Now that Chalabi had been eliminated as a potential leader amid accusations that he was secretly working for Iran (see April 2004), and the Sunnis had opted out of the elections entirely, the United States, by default, was backing a democratically elected government that maintained close ties to Iran and was linked to Shi’ite leaders whose powerful Shi’ite militias were battling the Sunnis.” Moreover, the Iraqi security forces have little intention of cooperating with the US’s plan to “stand up” as US forces “stand down.” Their loyalties are not to their country or their newly elected government, but to their individual militias. Journalist and author Nir Rosen says the Iraqi soldiers are mainly loyal to al-Sadr and to Abdul Aziz al-Hakim, the leader of the Supreme Council for the Islamic Revolution in Iraq (SCIRI, the other member of the United Iraq Alliance), “but not to the Iraqi state and not to anyone in the Green Zone.” Unger will write, “Unwittingly, America [is] spending billions of dollars to fuel a Sunni-Shi’ite civil war.” [Unger, 2007, pp. 327-329]
A former chief of the CIA’s station in Baghdad, Iraq (see December 2004), reportedly brags about mistreating detainees. Details of the comments, including who they are made to, are unknown. However, they do lead to an investigation, which finds that the former chief’s statements are untrue and that he was exaggerating. [McClatchy, 8/25/2009]
CIA Director Porter Goss tells the Senate: “Islamic extremists are exploiting the Iraqi conflict to recruit new anti-US jihadists. These jihadists who survive will leave Iraq experienced in, and focused on, acts of urban terrorism. They represent a potential pool of contacts to build transnational terrorist cells, groups and networks in Saudi Arabia, Jordan and other countries.” [New York Times Magazine, 9/11/2005]

[Source: American Rhetoric (.com)]In his State of the Union address, President Bush salutes the Iraqi voters and the US soldiers who made the recent national assembly elections possible (see January 30, 2005). Presenting Iraqi human rights advocate Safia Taleb al-Suharl as his special guest, Bush says that Iraq has finally turned the corner towards peace, democracy, and stability. Iraq is only the first, he continues: the US will foster “democratic movements and institutions in every nation and culture, with the ultimate goal of ending tyranny in our world.” Dimitri Simes, president of the more traditionally conservative Nixon Center, is aghast at Bush’s words and their implications. “If Bush means it literally,” Simes says, “then it means we have an extremist in the White House (see January 22, 2005). I hope and pray he didn’t mean it.” [White House, 2/2/2005; Unger, 2007, pp. 327]
More than 250 members of the Mujahedeen-e Khalq (MEK), a militant Iranian opposition group, return to Iran from Camp Ashraf in Iraq, accepting Iran’s December offer of amnesty. For years, the MEK leadership has assured the group’s members they faced certain death if they returned to Iran. Many remaining MEK members, over 3,500 in Iraq alone, say they are skeptical of the Iranian government’s promises and [Christian Science Monitor, 3/22/2005] dismiss the defectors as “quitters.” According to the Los Angeles Times, which interviewed several of Camp Ashraf’s residents, remaining MEK members appear to “show no interest” in going back. [Los Angeles Times, 3/19/2005]
The Army decides not to prosecute unnamed soldiers for killing an Iraqi detainee and attempting to cover up the death. The soldiers were stationed at Forward Operating Base Rifles near Al Asad, Iraq. In January 2004, several soldiers assaulted an Iraqi detainee. One lifted the detainee up from the floor by placing a baton under his chin, fracturing the detainee’s hyoid bone and causing his death. The soldiers were charged with negligent homicide, and with additional charges of conspiracy and making false statements. Apparently, the soldiers receive nothing more than written letters of reprimand and counseling. The officer completing the Commander’s Report on the offense writes, “Soldier should not be titled for any offense.” The detainee’s name is not revealed to the public. In an e-mail to a variety of Pentagon officials, an unnamed lieutenant colonel exults that the Pentagon’s Iraq propaganda operation using military analysts to promote the administration’s war policies is producing a “big payback.” He then writes, “There are about 50 retired military analysts that are part of this group… these are the folks that end up on FOX, CNN, etc. interpreting military happenings. These calls are conducted frequently and offer HUGE payback… these end up being the people who carry the mail on talk shows.” [Salon, 5/10/2008]
Iran’s chief nuclear negotiator, Hassan Rohani, says the Middle East will become even more unstable if Iran is sent to the UN Security Council over its nuclear program. “This would be a particular problem for the United States because it has a lot of troops and equipment in [the] region and is in fact our imposed neighbor,” he says. Iran has complained that United States forces have effectively encircled it, with troops stationed in both Iraq and Afghanistan. [Al Jazeera, 3/5/2005]

[Source: Miami New Times]The Palm Beach Post releases two undated videos from Iraq that the government had refused to release to the American Civil Liberties Union (ACLU). The videos, part of a set which will become known as the “Ramadi Madness” videos, were made by members of the West Palm Beach-based Bravo Company, 1st Battalion, 124th Infantry Regiment, stationed in Ramadi in 2002 and 2003. The videos are divided into segments called, among other titles, “See Haj Run” and “Blood Clot,” and depict scenes of urban fighting and Iraqis being captured and detained by US forces. In 2006, the government will authenticate the videos as being genuine (see May 2, 2006). The videos combine to make an approximately 26-minute long “crude documentary,” according to the Post, “created by a couple of [Bravo Company] sergeants.” The films were examined by Army investigators, who eventually concluded that they showed “inappropriate behaviors” but nothing criminal. The Post describes the videotaped scenes as ranging “from routine to poignant to macabre.” One shows a US soldier moving the hand of a dead Iraqi truck driver to “make him say ‘Hi.’” Another shows two soldiers pretending to choke a third with a plastic handcuff. A snippet entitled “Haji Cat” shows soldiers feeding and cuddling a kitten, which they’ve named “Anthrax.” Another shows an injured Iraqi man being pulled from the sidewalk into a building by other Iraqis. A later video shows an Iraqi prisoner on the ground with his hands bound and an off-screen voice saying, “I don’t know what the [expletive] this guy did, but he is a bad guy”; another detainee is receiving medical treatment for a head wound and being told to “smile for the camera.” A small group of soldiers interrogates a detainee. One video shows a homemade bomb made with plastic explosives packed in a rusted oil can. The “Blood Clot” video shows a US soldier kicking a wounded Iraqi and explaining, “This [expletive] shot at me.” The video moves to a close-up of an Iraqi detainee’s gunshot wound, then shows a group of women being detained while an off-screen voice declares, “Bad women.” One of the more graphic videos is titled “Friends Don’t Let Friends Play with Explosives.” It begins with a camera shot of burned and dismembered corpses, with an off-screen voice saying, “There’s the crater,” and, “That’s what you get, [expletive].” A soldier points to human remains and pokes the remains across the ground with his foot. Voices are heard off-screen, saying, “Oh, that’s part of his skull,” “That’s where the guy got thrown against the wall,” and, “They were setting the explosive, and it blew up on them.” Finally, “That’s your brain on idiocy” is said as the camera focuses on another pile of remains. A top-secret British government memo warns that Britain’s involvement in the Iraq war means that Britain will be a likely al-Qaeda target “for many years to come.” The memo, written by the Joint Intelligence Committee, the senior intelligence body in Britain which issues threat assessments, is entitled International Terrorism: Impact of Iraq. It is approved by the heads of Britain’s main intelligence agencies, MI5 and MI6. The memo states: “There is a clear consensus within the [British] extremist community that Iraq is a legitimate jihad and should be supported. Iraq has re-energized and re-focused a wide range of networks in [Britain].… We judge that the conflict in Iraq has exacerbated the threat from international terrorism and will continue to have an impact in the long term. It has reinforced the determination of terrorists who were already committed to attacking the West and motivated others who were not.… Iraq is likely to be an important motivating factor for some time to come in the radicalization of British Muslims and for those extremists who view attacks against [Britain] as legitimate.” It also says that Iraq is being used as a “training ground and base” for terrorists, and that terrorists are freely moving between Iraq and Britain. The memo is written in April 2005, but will not be leaked to the press until April 2006. It is circulated to Prime Minister Tony Blair and other top British officials before the 7/7 London bombings (see July 7, 2005). But after those bombings, Blair will repeatedly contradict the memo’s conclusions in public statements, denying any link between the Iraq war and an increase in terrorist activity in Britain. Blair will say that an “evil ideology,” not the war, has motivated suicide bombers, and, “The people who are responsible for terrorist attacks are terrorists.” [Sunday Times (London), 4/2/2006]
An employee of the watchdog organization Human Rights Watch (HRW) finds an unclassified draft of a document on the Defense Department’s Web site. The document proposes holding suspected Iraqi insurgents without trial in the same way that suspected Taliban and al-Qaeda members have been imprisoned at Guantanamo and other US detention facilities. When HRW publicly denounces the proposal, the Defense Department takes down its entire electronic library of unclassified documents, including hundreds of unrelated papers and memos. 'Kill Bush' T-Shirts, Wishes that Bush Had Been Aborted - Limbaugh tells his readers, “Dingy Harry Reid [D-NV, the Senate Minority Leader] and those absolute wimps have nothing positive to offer anybody in this country. They’re doing nothing but trying to instill fear and loathing, forming coalitions (i.e. their new bosom buddies MoveOn.org) built on seething hatred and rage. That is why it was no real surprise when CafePress.com began selling a yellow T-shirt with a red gash and the slogan, in big words, “Kill Bush.” The whole message was, “For Gods [sic] Sake, Kill Bush, Save the United States and the Rest of the World.” This was the same website that earlier posted a T-shirt for sale with the message, “Dear Tom DeLay, Please Commit Suicide. Sincerely, Everyone.” The same left-wing inhumanity was on display last year when [Democratic Senator] Hillary Clinton spoke at the pro-abortion ‘March for Women’s Lives.‘… [P]lacards held by the marchers read: ‘If Only Barbara Bush Had Choice;’ ‘Barbara Bush Chose Poorly;’ and ‘The Pope’s Mother Had No Choice.’ As I said, no shocker. But before removing the listing, his shirt was the subject of an article on the conservative Drudge Report, after which he received a torrent of angry e-mails—and six more shirt sales. Exaggerating Differences, Drawing Extreme Conclusions - Authors Kathleen Hall Jamieson and Joseph N. Cappella will later observe, “This is an in-group rhetoric seeking to reinforce the views of a like-minded audience eager to draw extreme conclusions about Democrats. The strategy capitalizes on tendencies scholars of in- and out-groups have repeatedly observed: that members of a group exaggerate their differences with out-groups, believing out-group members to be rather homogeneous and in-group members less so, and believing members of out-groups to be less human than those in the in-group. Studies also show that people in one group think that the attitudes of an opposed group are more extreme than they actually are…” Jamieson and Cappella argue that Limbaugh’s “in-group” of listeners and readers, often agitated by what the authors call “visceral” language and emotion, has less trouble believing that the “out-group,” Democrats, would solidly back such extremist calls for presidential assassinations and coerced suicides, than would a more disparate group of political observers. “Flooded by the evocative cascade,” they will write, “the reader is likely to grant the implications in the ambiguously referenced (Is Senator Clinton the object of the same left-wing inhumanity or the sentiments expressed in the placards at the rally?) bridging inference (“the same left-wing inhumanity”) and conclude that Hillary Clinton abetted, if she did not outright endorse, the notion that the incumbent president and the pope should have been aborted and the incumbent president killed. At the same time, the audience is unlikely to challenge the conclusion that the T-shirt statements reflect the Democratic mainstream… If these are the sentiments of the Democratic mainstream, then, of course, the Democratic Party is the home of ‘wacko voters and supporters.’” [Jamieson and Cappella, 2008, pp. 177-178]

Emiliano Santiago. [Source: Elliot Margolies]Oregon National Guardsman Emiliano Santiago’s lawsuit against his forcible redeployment back to Iraq begins in a Seattle, Washington, appeals court. Santiago spent eight years in the Guard, and his term of duty expired in June 2004. But four months later, the Army ordered him to ship out to Afghanistan. It also reset his military termination date to December 24, 2031. (The 26-year extension was explained by Army lawyers as being made for “administrative convenience.”) Santiago refused to go, and filed a lawsuit naming Secretary of Defense Donald Rumsfeld as the defendant. The lawsuit, Santiago v. Secretary of Defense Donald Rumsfeld, is the highest court review of the Army’s controversial “stop-loss” policy (see November 2002, November 13, 2003, Early January, 2004, and June 2, 2004) to date. Army lawyers say that under the November 2002 “stop-loss” policy, President Bush can “suspend any provision of the law relating to promotion, retirement or separation” of any soldier who is deemed essential to national security in times of crisis. Santiago’s lawyers say in a written statement: “Conscription for decades or life is the work of despots.… It has no place in a free and democratic society.… If the government can break its promises to young men and women like Santiago, then the bedrock of our all-volunteer army—trust in the government’s promises—will crumble.” Many legal observers believe that if Santiago loses in the appeals court, he and his lawyers will push the case all the way to the Supreme Court. Ironically, Santiago is slated to be redeployed to Afghanistan within a week, and may not be on hand to hear whether he wins or loses his case. [Seattle Times, 4/6/2005] Santiago says it is not a matter of politics for him, but of fairness. “If I still had two years or one year left of my contract, I would say, ‘I signed up for it, I’m in,’” he says. “This is not right. [The Army is] not doing what they told me they were going to do.… It’s crazy.” Santiago recalls being told by his recruiter in 1997 that there was virtually no chance of his being sent overseas for active duty. According to Santiago, the recruiter told him, “The only reason the National Guard would get deployed is if there was, like, a World War III.” [Seattle Weekly, 3/30/2005] Santiago will lose the lawsuit, and will redeploy to Afghanistan (see April 15, 2005). The National Convention for a Democratic, Secular Republic in Iran is held in Washington, DC and attended by about 300 supporters. Speakers at the event include members of Congress, legal scholars, and Maryam Rajavi, president-elect of the National Council of Resistance of Iran (NCRI), the political wing of Mujahedeen-e Khalq (MEK). Rep. An appeals court rules unanimously that Sergeant Emiliano Santiago must redeploy to Iraq under the military’s “stop-loss” program. Santiago filed a lawsuit to prevent his forcible redeployment, saying that he had already fulfilled his eight-year enlistment (see April 6, 2005). He unwillingly returns to Afghanistan today. [Oakland Tribune, 1/14/2006] Supreme Court Justice Sandra Day O’Connor rejected Santiago’s request for his case to be reviewed by the Court. In defense of Santiago, Representative Jim McDermott (D-WA) told the House: “His case—his plight—should be known, and feared, by every high-school junior and senior across the country. The ugly little secret in the Pentagon is that Emiliano Santiago’s voluntary service is now involuntary.” [Seattle Times, 4/15/2005]
The cabinet for the elected Iraqi Transitional Government in Iraq is approved, with Shiite figure Bayan Jabr as the new interior minster. Jabr was a former member of the Iranian-supported Badr Brigade, which is the military wing of the Supreme Council for the Islamic Revolution in Iraq SCIRI). As head of the Interior Ministry he will be charged with purging it of Sunnis and absorbing the Badr Brigade into the country’s police and paramilitary units. Human Rights Watch reports that 12 former members of the Mujahedeen-e Khalq (MEK) have alleged they were subjected to routine detention, solitary confinement, beatings, and torture as punishment for criticizing MEK leadership or trying to leave its ranks. The former MEK members, now in Europe, told Human Rights Watch that they spent several years in Abu Ghraib prison until Saddam Hussein released them during his last year in power. One of those interviewed, according to the report, recalled that during the mid-1990s a prisoner died after an intense beating. Two other former MEK members said they were held in solitary confinement for extensive periods of time, one for five years, and the other for eight and a half years. After the report’s release, Mujahedeen-e Khalq (MEK) denies the allegations cited in the report. [Human Rights Watch, 5/2005; BBC, 5/19/2005]
Jordanian journalist Fuad Hussein publishes a book that extensively quotes Saif al-Adel, who is believed to be al-Qaeda’s current military commander and possibly lives in Iran (see Spring 2002). Al-Adel claims: “Abu Musab [al-Zarqawi] and his Jordanian and Palestinian comrades opted to go to Iraq.… Our expectations of the situation indicated that the Americans would inevitably make a mistake and invade Iraq sooner or later. Such an invasion would aim at overthrowing the regime. Therefore, we should play an important role in the confrontation and resistance. Contrary to what the Americans frequently reiterated, al-Qaeda did not have any relationship with Saddam Hussein or his regime. We had to draw up a plan to enter Iraq through the north that was not under the control of [Hussein’s] regime. We would then spread south to the areas of our fraternal Sunni brothers. The fraternal brothers of the Ansar al-Islam expressed their willingness to offer assistance to help us achieve this goal.” [Bergen, 2006, pp. 120, 361-362] He says “the ultimate objective was to prompt” the US “to come out of its hole” and take direct military action in an Islamic country. “What we had wished for actually happened. It was crowned by the announcement of Bush Jr. of his crusade against Islam and Muslims everywhere.” [New York Times Magazine, 9/11/2005] Al-Adel seems to have served as a liaison between al-Qaeda and al-Zarqawi, and mentions elsewhere in the book that his goal was not “full allegiance” from al-Zarqawi’s group, but “coordination and cooperation” to achieve joint objectives. Blackwater Worldwide, one of several Blackwater brand companies, deploys CS nerve gas on a crowded Green Zone checkpoint from both a helicopter and an armored vehicle. Army Captain Kincy Clark documents and reports the incident. Former Army lawyers will state that use of such riot control agents requires the approval of the military’s most senior commanders. Blackwater initially had a contract to provide security for American officials in Iraq with the Coalition Provisional Authority, an agreement which did not address the use of CS gas. When the contracts for Blackwater, DynCorp, and Triple Canopy are renewed after the incident, these contracts will forbid the use of CS gas. Commanders in the field will state that they fear the incident being used for propaganda by insurgents, who will say the US was using chemical weapons. [New York Times, 1/10/2008]
The predominantly Shiite Arab administration of Ibrahim al-Jaafari is sworn into office with several posts unfilled. It was originally planned that a Sunni Arab would hold the position of defense minister, but the appointment was blocked by the Shiite officials who said that he had close ties to the deposed Baathist regime. [New York Times, 5/4/2005]
The corpses of Sunni males begin appearing in Baghdad’s main morgue after reportedly being detained by men wearing police uniforms. The abductors are often seen driving Toyota Land Cruisers and armed with Glocks. A US official claims that police uniforms can be bought for a cheap price by non-governmental armed groups. But unexplained is how the attackers can afford Toyotas and Glocks, both of which are very expensive and usually only used by Western contractors and Iraqi government forces. Faik Baqr, director of the morgue, tells Knight Ridder that the bodies always look as if they were killed in a “methodical” fashion. The bodies are often tortured and mutilated with their eyes blindfolded.
They look as if they had been “whipped with a cord, subjected to electric shocks or beaten with a blunt object and shot to death, often with single bullets to their heads.” The torture markings are similar to those that have been found on the bodies of survivors rescued from Interior Ministry prisons by the human rights ministry. The morgue director also says that he has been receiving about 700 to 800 suspicious deaths a month ever since May, with 500 having firearm wounds. [Knight Ridder, 6/28/2005]
Outgoing Undersecretary of Defense Douglas Feith, one of the key architects of the Iraq occupation, is bemused by the fact that, despite his predictions and those of his neoconservative colleagues, Iraq is teetering on the edge of all-out civil war. He has come under fire from both political enemies and former supporters, with Senator Carl Levin (D-MI) accusing him of deceiving both the White House and Congress, and fellow neoconservative William Kristol accusing him of “being an agent of” disgraced Defense Secretary Donald Rumsfeld (see November 6-December 18, 2006). Feith defends the invasion of Iraq, calling it “an operation to prevent the next, as it were, 9/11,” and noting that the failure to find WMD is essentially irrelevant to the justification for the war. “There’s a certain revisionism in people looking back and identifying the main intelligence error [the assumption of stockpiles] and then saying that our entire policy was built on that error.” Feith is apparently ignoring the fact that the administration’s arguments for invading Iraq—including many of his own assertions—were built almost entirely on the “error” of the Iraqi WMD threat (see July 30, 2001, Summer 2001, September 11, 2001-March 17, 2003, Shortly After September 11, 2001, September 14, 2001, September 19-20, 2001, September 20, 2001, October 14, 2001, November 14, 2001, 2002, 2002-March 2003, February 2002, Summer 2002, August 26, 2002, September 3, 2002, September 4, 2002, September 8, 2002, September 8, 2002, September 10, 2002, September 12, 2002, Late September 2002, September 19, 2002, September 24, 2002, September 24, 2002, September 28, 2002, October 7, 2002, December 3, 2002, December 12, 2002, January 9, 2003, February 3, 2003, February 5, 2003, February 8, 2003, March 22, 2003, and March 23, 2003, among others).
Cultural Understanding Did Not Lead to Success - Feith says he is not sure why what he describes as his deep understanding of Iraqi culture did not lead to accurate predictions of the welcome the US would receive from the Iraqi people (see November 18-19, 2001, 2002-2003, September 9, 2002, and October 11, 2002). “There’s a paradox I’ve never been able to work out,” he says. “It helps to be deeply knowledgeable about an area—to know the people, to know the language, to know the history, the culture, the literature. But it is not a guarantee that you will have the right strategy or policy as a matter of statecraft for dealing with that area. You see, the great experts in certain areas sometimes get it fundamentally wrong.” Who got it right? President Bush, he says. “[E]xpertise is a very good thing, but it is not the same thing as sound judgment regarding strategy and policy. George W. Bush has more insight, because of his knowledge of human beings and his sense of history, about the motive force, the craving for freedom and participation in self-rule, than do many of the language experts and history experts and culture experts.”
'Flowers in Their Minds' - When a reporter notes that Iraqis had not, as promised, greeted American soldiers with flowers, Feith responds that they were still too intimidated by their fear of the overthrown Hussein regime to physically express their gratitude. “But,” he says, “they had flowers in their minds.” [New Yorker, 5/9/2005; Scoblic, 2008, pp. 228-229]
Iran’s foreign minister, Kamal Kharrazi, visits Iraq and meets with top officials, including Iraqi Prime Minister Ibrahim al-Jaafari. The visit marks the highest profile meeting between Iran and Iraq since US forces ousted Saddam Hussein in spring of 2003. At a news conference, Kharrazi tells reporters, “We will not allow terrorists to use our lands to access Iraq,” and adds, “We will watch our borders and will arrest infiltrators, because securing Iraq is securing the Islamic Republic.” [CNN, 5/17/2005; Christian Science Monitor, 5/20/2005]
The London Times reports that according to a senior insurgent commander in Iraq, injured Jordanian militant Abu Musab al-Zarqawi has fled Iraq, possibly to Iran. Zarqawi has claimed responsibility for numerous bombings, assassination, and beheadings across Iraq since the fall of Saddam Hussein in March 2003. According to the insurgent commander, al-Zarqawi’s convoy was attacked as they were escaping an American offensive near the town of al-Qaim in northwestern Iraq in early April. [Sunday Times (London), 5/29/2005] Iranian Foreign Ministry spokesperson Hamid Reza Asefi dismisses the report as “amateur newsmaking.” [Associated Press, 5/29/2005]
The Army suppresses an unclassified report by the RAND Corporation, a federally financed think tank that often does research for the military. The report, entitled “Rebuilding Iraq,” was compiled over 18 months; RAND submitted a classified and an unclassified version, hoping that the dissemination of the second version would spark public debate. However, senior Army officials are disturbed by the report’s broad criticisms of the White House, the Defense Department, and other government agencies, and the Army refuses to allow its publication. A Pentagon official says that the biggest reason for the suppression of the report is the fear of a potential conflict with Defense Secretary Donald Rumsfeld. The unclassified version of the report will be leaked to the New York Times in February 2008. That version finds problems with almost every organization and agency that played a part in planning for the Iraq invasion.
Bush, Rice Let Interdepartmental Squabbles Fester - The report faults President Bush, and by implication his former National Security Adviser Condoleezza Rice, for failing to resolve differences between rival agencies, particularly between the departments of Defense and State. “Throughout the planning process, tensions between the Defense Department and the State Department were never mediated by the president or his staff,” the report finds.
Defense Department Unqualified to Lead Reconstruction Effort - The report is also critical of the Defense Department’s being chosen to lead postwar reconstruction, citing that department’s “lack of capacity for civilian reconstruction planning and execution.” The Bush administration erred in assuming that reconstruction costs would be minimal, and in refusing to countenance differing views, the report says. Complementing that problem was the failure “to develop a single national plan that integrated humanitarian assistance, reconstruction, governance, infrastructure development and postwar security.” As a result, the report finds, “the US government did not provide strategic policy guidance for postwar Iraq until shortly before major combat operations commenced.”
State's Own Planning 'Uneven' and Not 'Actionable' - It questions the “Future of Iraq” study (see April 2002-March 2003), crediting it with identifying important issues, but calling it of “uneven quality” and saying it “did not constitute an actionable plan.”
Franks, Rumsfeld Exacerbated Problems - General Tommy Franks, who oversaw the entire military operation in Iraq, suffered from a “fundamental misunderstanding” of what the military needed to do to secure postwar Iraq, the study finds. Franks and his boss, Rumsfeld, exacerbated the situation by refusing to send adequate numbers or types of troops into Iraq after the fall of Baghdad.
Strengthened Resistance to US Occupation - The poor planning, lack of organization, and interdepartmental dissension together worked to strengthen the Iraqi insurgency. As Iraqi civilians continued to suffer from lack of security and essential services, resentment increased against the “negative effects of the US security presence,” and the US failed to seal Iraq’s borders, foreign and domestic support for the insurgents began to grow.
RAND Study Went Too Far Afield, Says Army - In 2008, after the Times receives the unclassified version of the report, Army spokesman Timothy Muchmore explains that the Army rejected the report because it went much farther than it should in examining issues pertinent to the Army. “After carefully reviewing the findings and recommendations of the thorough RAND assessment, the Army determined that the analysts had in some cases taken a broader perspective on the early planning and operational phases of Operation Iraqi Freedom than desired or chartered by the Army,” Muchmore will say. “Some of the RAND findings and recommendations were determined to be outside the purview of the Army and therefore of limited value in informing Army policies, programs and priorities.”
Recommendations - The Army needs to rethink its planning towards future wars, the report finds. Most importantly, it needs to consider the postwar needs of a region as much as it considers the strategy and tactics needed to win a war. [New York Times, 2/11/2008]

Former director of Israeli intelligence Uzi Arad says that many Israelis were keenly disappointed in the Bush administration’s decision to invade Iraq and not Iran. Arad says: “If you look at President Bush’s ‘axis of evil’ (see January 29, 2002), all of us said North Korea and Iran are more urgent. Iraq was already semi-controlled because there were [UN-imposed economic] sanctions. It was outlawed. Sometimes the answer [from the Bush neoconservatives] was ‘Let’s do first things first. Once we do Iraq, we’ll have a military presence in Iraq, which would enable us to handle the Iranians from closer quarters, would give us more leverage.’” Arad’s words are almost verbatim echoes from three years before (see Late January 2002). [Unger, 2007, pp. 307-308]
US Defense Secretary Donald H. Rumsfeld warns governments in Middle East not to help Abu Musab al-Zarqawi, recently reported to have been seriously injured in Iraq. “Were a neighboring country to take him in and provide medical assistance or haven for him, they, obviously, would be associating themselves with a major linkage in the al-Qaeda network and a person who has a great deal of blood on his hands.” [US Department of Defense, 6/1/2005] Zarqawi is rumored to have fled to Iran for treatment (see May 29, 2005).
At the Asia Oil and Gas Conference in Kuala Lumpur, Natik al-Bayati, director general of Iraq’s Oil Exploration Company, tells reporters that Iraqi officials are hoping that foreign oil companies will return to Iraq and begin working by the third quarter of 2006. “Hopefully by the first quarter of 2006 the companies will come back. Maybe by mid-year or the third quarter [of 2006]. This is what we have in mind,” he says. He explains that the objective is to increase production to 3.5 million-4 million barrels per day by 2010. To meet this goal, Iraq’s exploration sector will need between $15 billion and $20 billion, he says. [International Oil Daily, 6/15/2005] Iraq will have to begin negotiating with the oil companies this year in order to make that deadline. As one observer notes, this would be taking place “before a legitimate Iraqi government is elected and in parallel with the writing of a Petroleum Law. This time frame means that contracts will be negotiated without public participation or debate, or proper legal framework.” [Muttitt, 2005]
Jed Babbin. [Source: The Intelligence Summit]Three days before a group of military analysts are taken to Guantanamo by the Pentagon for an orchestrated “tour” (see June 24-25, 2005), one planning e-mail from Pentagon official Dallas Lawrence gives weight to the belief that the tour was arranged to prepare the analysts to deliver scripted talking points before the cameras (see April 20, 2008 and Early 2002 and Beyond). Lawrence notes the importance of scheduling the Guantanamo trip to ensure that an analyst for the American Spectator, Jed Babbin, can participate: “He is hosting a number of radio shows this summer. I would have to think he would have every member of Congress on to talk about their trip together—a definite plus for us looking to expand the echo chamber.” Babbin will respond with a Spectator article lambasting Democratic critics of Guantanamo, and will be given an invitation to appear on Bill O’Reilly’s Fox News talk show. Pentagon public relations official Lawrence Di Rita is quite pleased by Babbin’s work, and in an e-mail to other Pentagon officials, says: “We really should try to help [Babbin]. [Source: CNN]Within hours of returning from a Pentagon-sponsored “fact-finding” trip to the Guantanamo detention facility (see June 24-25, 2005), CNN military analyst Don Shepperd, as planned (see June 25, 2005), extolls the virtues of the Pentagon’s handling of detainees on a lineup of CNN news broadcasts. As per his most recent briefing, he does not mention the case of Mohammed al-Khatani (see August 8, 2002-January 15, 2003), who has suffered extensive brutality at the hands of his captors. Instead, his “analyses” are so uniformly laudatory that, as commentator Glenn Greenwald will observe, they are “exactly what it would have been had [Defense Secretary Donald] Rumsfeld himself written the script.” After returning from his half-day visit, he participates in a live telephone interview with CNN anchor Betty Nguyen. He opens with the observation: “I tell you, every American should have a chance to see what our group saw today. The impressions that you’re getting from the media and from the various pronouncements being made by people who have not been here, in my opinion, are totally false. What we’re seeing is a modern prison system of dedicated people, interrogators and analysts that know what they are doing. And people being very, very well-treated. We’ve had a chance to tour the facility, to talk to the guards, to talk to the interrogators and analysts. We’ve had a chance to eat what the prisoners eat. We’ve seen people being interrogated. And it’s nothing like the impression that we’re getting from the media. People need to see this, Betty.… I have been in prisons and I have been in jails in the United States, and this is by far the most professionally-run and dedicated force I’ve ever seen in any correctional institution anywhere.” Shepperd watched an interrogation, and he describes it thusly: “[T]hey’re basically asking questions. They just ask the same questions over a long period of time. They get information about the person’s family, where they’re from, other people they knew. All the type of things that you would want in any kind of criminal investigation. And these were all very cordial, very professional. There was laughing in two of them that we…” Nguyen interrupts to ask, “Laughing in an interrogation?” and Shepperd replies: “In the two of them that we watched. Yes, indeed. It’s not—it’s not like the impression that you and I have of what goes on in an interrogation, where you bend people’s arms and mistreat people. They’re trying to establish a firm professional relationship where they have respect for each other and can talk to each other. And yes, there were laughing and humor going on in a couple of these things. And I’m talking about a remark made where someone will smirk or laugh or chuckle.” In another CNN interview three days later, Shepperd reiterates and expands upon his initial remarks, and says of the detainees: “[W]e have really gotten a lot of information to prevent attacks in this country and in other countries with the information they’re getting from these people. And it’s still valuable.” CNN does not tell its viewers that Shepperd is president of The Shepperd Group, a defense lobbying and consulting firm. [CNN, 6/24/2005; Salon, 5/9/2008]
Retired Air Force General Donald Shepperd, a CNN news analyst, returns from a “fact-finding” trip to Guantanamo Bay (see June 24-25, 2005) prepared to provide Pentagon talking points to CNN audiences. Shepperd is remarkably candid about his willingness to serve as a Pentagon propagandist, writing in a “trip report” he files with his handlers, “Did we drink the ‘Government Kool-Aid?’—of course, and that was the purpose of the trip.” He acknowledges that “a one day visit does not an expert make” (Shepperd and his fellow analysts spent less than four hours touring the entire facility, all in the company of Pentagon officials), and notes that “the government was obviously going to put its best foot forward to get out its message.” He adds that “former military visitors are more likely to agree with government views than a more appropriately skeptical press.” Shepperd also sends an e-mail to Pentagon officials praising the trip and asking them to “let me know if I can help you.” He signs the e-mail, “Don Shepperd (CNN military analyst).” Shepperd’s e-mail is forwarded to Larry Di Rita, a top public relations aide to Secretary of Defense Donald Rumsfeld. Di Rita’s reply shows just how much control the Pentagon wields over the analysts. Di Rita replies, “OK, but let’s get him briefed on al-Khatani so he doesn’t go too far on that one.” Di Rita is referring to detainee Mohammed al-Khatani (see August 8, 2002-January 15, 2003), who had been subjected to particularly brutal treatment. Shepperd will, as planned, praise the Guantanamo detainee program on CNN in the days and hours following his visit to the facility (see June 24-25, 2005). [Salon, 5/9/2008] He will say in May 2008: “Our message to them as analysts was, ‘Look, you got to get the importance of this war out to the American people.’ The important message is, this is a forward strategy, it is better to fight the war in Iraq than it is a war on American soil.” [PBS, 5/1/2008]

Retired General Montgomery Meigs and retired Colonel Jack Jacobs (who will be praised in 2008 by NBC’s Brian Williams for his independence—see April 29, 2008) take part in a session that is documented in an internal Pentagon e-mail. Suggestions in the Jacobs/Meigs session include providing information and photographs to all network presidents; not scheduling prime-time press conferences for Defense Secretary Donald Rumsfeld; only make Rumsfeld available to the press after priming reporters with information and photos, and ensuring that press questioning take place in places in which Rumsfeld is comfortable; and providing an “exclusive” report or analysis to the Washington Post. Both Meigs and Jacobs are routinely touted as “independent analysts” by MSNBC; both are shown to be quite reliable in providing Pentagon talking points by the Pentagon’s tracking system (see 2005 and Beyond). [Source: The Intelligence Summit]“Independent military analyst” Gordon Cucullu, a former Green Beret, is an enthusiastic participant in the Pentagon’s Iraq propaganda operation (see April 20, 2008 and Early 2002 and Beyond). Cucullu has just returned from a half-day tour of the Guantanamo detention facility (see June 24-25, 2005), and is prepared to give the Pentagon’s approved message to the media.
Talking Points Covered in Fox Appearance - In an e-mail to Pentagon official Dallas Lawrence, he alerts the department to a new article he has written for conservative Website FrontPage, and notes that he has appeared on an early-morning broadcast on Fox News and delivered the appropriate talking points: “I did a Fox & Friends hit at 0620 this morning. Good emphasis on 1) no torture, 2) detainees abuse guards, and 3) continuing source of vital intel.” [Salon, 5/9/2008]
Op-Ed: Pampered Detainees Regularly Abuse Guards - In the op-ed for FrontPage, entitled “What I Saw at Gitmo,” he writes that the US is being “extraordinarily lenient—far too lenient” on the detainees there. There is certainly abuse going on at Guantanamo, Cucullu writes—abuse of soldiers by the detainees. Based on his three-hour tour of the facility, which included viewing one “interrogation” and touring an unoccupied cellblock, Cucullu says that the detainees “fight their captors at every opportunity” and spew death threats against the soldiers, their families, and Americans in general. The soldiers are regularly splattered with “feces, urine, semen, and spit.” One detainee reportedly told another, “One day I will enjoy sucking American blood, although their blood is bitter, undrinkable.” US soldiers, whom Cucullu says uniformly treat the detainees with courtesy and restraint (see August 8, 2002-January 15, 2003), are constantly attacked by detainees who wield crudely made knives, or try to “gouge eyes and tear mouths [or] grab and break limbs as the guards pass them food.” In return, the detainees are given huge meals of “well-prepared food,” meals which typically overflow from two styrofoam containers. Many detainees insist on “special meal orders,” and throw fits if their meals are not made to order. The level of health care they are granted, Cucullu says, would suit even the most hypochondriac American. Cucullu writes that the detainees are lavished with ice cream treats, granted extended recreational periods, live in “plush environs,” and provided with a full array of religious paraphernalia. “They are not abused, hanged, tortured, beheaded, raped, mutilated, or in any way treated the way that they once treated their own captives—or now treat their guards.” The commander, Brigadier General Jay Hood, tells Cucullu that such pampered treatment provides better results than harsher measures. “Establishing rapport” is more effective than coercion, Hood says, and, in Cucullu’s words, Hood “refers skeptics to the massive amount of usable intelligence information [the detainees] produce even three years into the program.” In conclusion, Cucullu writes, the reader is “right to worry about inhumane treatment” at Guantanamo, but on behalf of the soldiers, not the detainees. Italian document peddler Rocco Martino, who first sold the forged documents purporting to prove a secret uranium deal between Iraq and Niger (see March 2000, Late June 2002, Afternoon October 7, 2002, and Summer 2004), tells the British news daily The Guardian: “It was the Italians and Americans who were behind it. It was all a disinformation operation. [I was] a tool used by someone for games much bigger than me.” [Unger, 2007, pp. 237]
The Pentagon, tracking every bit of media coverage provided by the “independent military analysts” who are part of its Iraq propaganda program (see April 20, 2008 and Early 2002 and Beyond), is particularly pleased with the results of its half-day tour of Guantanamo for selected analysts (see June 24-25, 2005). Its tracking (see 2005 and Beyond) finds that Lieutenant Colonel Gordon Cucullu (see June 27, 2005) receives the most coverage during the almost two weeks after the tour, followed by Major General Donald Shepperd (see June 24-27, 2005). In all, the analysts made 37 media appearances. They emphasized the following talking points:
Prisoner/Guard Abuse -

The US-Iraq Joint Commission on Reconstruction and Economic Development meets in Amman, Jordan, to discuss Iraq’s progress in implementing a number of reforms that will help transition the country to a market-based economy (see, e.g., September 29, 2004). During the two-day meeting, Iraqi representatives reconfirm their commitment to scaling back fuel and food subsidies. They also announce the opening of a USAID-backed Investment Promotion Agency that will help Iraqi and foreign investors open businesses in Iraq. [US Department of State, 7/13/2005]
The Bush administration’s relentless public relations campaign to sell the Iraq war is falling flat, crushed under the weight of events, according to author and media critic Frank Rich. Its new marketing slogan—“As the Iraqis stand up, we’ll stand down”—leaves most listeners cold, according to surveys. When President Bush proclaims that “30 Iraqi battalions [are] in the lead” in the fighting, his words are disproven within hours, by statements from his own commanders to Congress that note the number of Iraqi battalions fighting alongside American forces has declined from three to one. Rich will put the facts into his own words: “750 soldiers were now ready to stand up on their own should America’s 140,000 troops stand down.” Bush officials also try to claim a victory by announding the death of “the second most wanted al-Qaeda leader in Iraq,” the “top operational commander of al-Qaeda in Baghdad.” The news makes little, if any, impact in the media or on the American citizenry. “He may not even be one of the top 10 or 15 leaders,” one Iraq expert tells reporters. Lastly, Bush officials’ lofty claims of stopping 10 al-Qaeda plots draw little besides scorn. According to Rich, Americans know by now that these so-called plots have been roundly debunked, proven either to be the same ones that have been endlessly trotted out over the years, far less substantial than originally reported, or merely lies. [Rich, 2006, pp. 198]
William Cowan. [Source: The Intelligence Summit]Fourteen Marines die in Iraq. Hours after their deaths, William Cowan, a retired Marine colonel and Fox News analyst (see April 20, 2008 and Early 2002 and Beyond) who has grown increasingly uncomfortable with what he will later call the Pentagon’s “twisted version of reality” being pushed on analysts in briefings, telephones the Pentagon to advise officials that his upcoming comments on Fox “may not all be friendly.” He is then given a private briefing, quickly arranged by Defense Secretary Donald Rumsfeld’s senior aides. But Cowan then tells Fox host Bill O’Reilly that it has been “a bad week” in Iraq, that many military officials he has talked to were “expressing a lot of dismay and disappointment at the way things are going,” and the US is “not on a good glide path right now” in Iraq. The repercussions are almost immediate. According to Cowan, he is “precipitously fired from the analysts group” for this appearance. The Pentagon “simply didn’t like the fact that I wasn’t carrying their water.” Cowan later recalls: “Suddenly, boom, I never got another telephone call, I never got another e-mail from them.… I was just booted off the group. I was fired.” Cowan will say that he and other analysts were given special access only “as long as they thought I was serving their purposes.… I drink nobody’s Kool-Aid.” The next day, the other analysts take part in a conference call with General James Conway, the director of operations for the Joint Chiefs of Staff, where he urges them not to let the Marines’ deaths erode support for the war. Conway is blunt, saying directly that the US citizenry is the main target of Pentagon propaganda. “The strategic target remains our population,” he tells them. “We can lose people day in and day out, but they’re never going to beat our military. What they can and will do if they can is strip away our support. And you guys can help us not let that happen.” An analyst chimes in, “General, I just made that point on the air.” Conway says, “Let’s work it together, guys.” [New York Times, 4/20/2008; Washington Post, 4/21/2008]
Camp Casey. [Source: Indybay (.org)]Antiwar activist Cindy Sheehan, of Vacaville, California, sets up “Camp Casey” three miles outside of President Bush’s Crawford, Texas ranch. Bush has come to his ranch for his yearly August vacation; Sheehan has come to demand a meeting with Bush to discuss the loss of her son, Casey, in Iraq. Sheehan chooses the date to coincide with the fourth anniversary of the briefing that warned Bush of Osama bin Laden’s intention to attack the US (see August 6, 2001). Camp Casey begins as a single pup tent in a ditch by the side of a dirt road, in which Sheehan intends to stay for whatever time it takes to secure a meeting with Bush. Author and media critic Frank Rich later writes that because Bush is so firmly ensconsced in the protective “bubble” that shields him from awareness of criticism, he and his top officials are blindsided by the media response to Sheehan’s lonely vigil. Casey Sheehan, who died in April 2004 a mere two weeks after his arrival in Iraq (see April 4, 2004), will become, Rich will write, emblematic of both “the noble intentions of those who volunteered to fight the war [and] also the arrogance, incompetence, and recklessness of those who gave the marching orders.”
Bush Refuses to Meet with Sheehan - Bush will refuse to meet with Sheehan and the increasing number of peace activists who gather at Camp Casey, causing him inordinate embarrassment (see August 12, 2005) as more and more reporters begin questioning his motives in refusing to meet with the bereaved mother of a fallen US soldier. Bush even ignores the advice of some of his public relations staffers and fellow Republicans, who ask him to reconsider, as Senator George Allen (R-VA) says, “as a matter of courtesy and decency.” Rich will write: “Only someone as adrift as Bush would need to be told that a vacationing president couldn’t win a standoff with a grief-stricken parent commandeering TV cameras and the blogosphere 24/7. But the White House held firm. In a particularly unfortunate gesture, the presidential motorcade, in a rare foray out of the vacation compound, left Sheehan in the dust on its way to a fundraiser at a fat cat’s ranch nearby” (see August 12, 2005). [Rich, 2006, pp. 193-196] Political analyst Charlie Cook says: “Anything that focuses media and public attention on Iraq war casualties day after day—particularly [something] that is a good visual for television, like a weeping Gold Star mother—is a really bad thing for President Bush and his administration.… Americans get a little numb by the numbers of war casualties, but when faces, names, and families are added, it has a much greater effect.” Republican strategist Kellyanne Conway agrees, saying: “Cindy Sheehan has tapped into a latent but fervent feeling among some in this country who would prefer that we not engage our troops in Iraq. She can tap into what has been an astonishingly silent minority since the end of last year’s presidential contest. It will capture attention.” University professor Stephen Hess says that Sheehan’s “movement… can be countered by a countermovement” and therefore negated, but “I think the president might have defused the situation if he had invited her in instantly.” Hess predicts that Sheehan will soon be targeted by Republican strategists in a counterattack (see August 11, 2005 and After).
Focus of Antiwar Movement - Camp Casey quickly becomes the focus of the American antiwar movement, with organizations such as MoveOn.org and Code Pink pitching in to help expand and coordinate the camp, and high-profile Democratic operatives such as Joe Trippi organizing support among left-wing bloggers. MoveOn’s Tom Mattzie says: “Cindy reached out to us.… Cindy is a morally pure voice on the war, so we’re trying to keep the focus on her and not jump in and turn it into a political fight.” [Los Angeles Times, 8/11/2005]

Sheehan, who has requested a meeting with President Bush during his vacation at his ranch in Texas, says she is not satisfied with the meeting with Hadley and Hagin. “I don’t believe his phony excuses for the war,” she says. “I want him to tell me why my son died (see April 4, 2004). If he gave the real answer, people in this country would be outraged—if he told people it was to make his buddies rich, that it was about oil.” [Los Angeles Times, 8/11/2005]

Unlike Sheehan, Pruett and her family staunchly support the war; also unlike Sheehan, Pruett has not lost any of her sons. Apparently the White House found Pruett after learning of her family’s appearance on CNN in June 2004, where she defended the war effort, and contacted the family a week before the event. “An obviously delighted President Bush,” who has repeatedly refused to meet with Sheehan (see August 12, 2005), flies to Idaho to introduce Pruett to what the Washington Post calls “a boisterous invitation-only audience mostly made up of military families.” Bush tells the audience: “There are few things in life more difficult than seeing a loved one go off to war. And here in Idaho, a mom named Tammy Pruett—I think she’s here—knows that feeling six times over. Tammy has four sons serving in Iraq right now with the Idaho National Guard—Eric, Evan, Greg, and Jeff. Last year, her husband Leon and another son, Eren, returned from Iraq, where they helped train Iraqi firefighters in Mosul. Tammy says this—and I want you to hear this—‘I know that if something happens to one of the boys, they would leave this world doing what they believe, what they think is right for our country. And I guess you couldn’t ask for a better way of life than giving it for something that you believe in.’ America lives in freedom because of families like the Pruetts.” Bush kisses Pruett on the cheek after the speech, then sends her out to talk to the press. Pruetts Offer Condolences to Sheehan, Other Bereaved Families - But the Pruetts are not willing to merely serve as props for the White House’s pro-war agenda. Both Leon and Tammy Pruett are quick to offer tearful condolences to families who have lost loved ones overseas, specifically naming Sheehan. Tammy says while her family supports the war, they do not want to be seen as criticizing those who oppose it. “We don’t feel like we’re out here trying to be a poster family, we’re just proud of our sons,” she says. Careful Staging - The Post notes that the Pruett speech is viewed by White House planners “as a crucial opportunity for Bush to show both compassion and resolve when his conduct of the war is increasingly being publicly questioned, and polls of public support are flirting with Vietnam War-era depths.” The speech and presentation are carefully crafted, with a drum corps playing the themes of each of the five branches of service, and Bush placed before a group of soldiers dressed in fatigues and arrayed in front of a huge red, white, and blue backdrop festooned with photographs of soldiers, police officers, firefighters, and rescue workers beneath the heading “Honoring America’s Soldiers.” The entire event, Knight Ridder reporter William Douglas writes, is designed to “creat[e] a visual link between the Sept. 11, 2001, terrorist attacks and the war in Iraq.” [MSNBC, 8/24/2005; Washington Post, 8/25/2005]

Bunnatine H. Greenhouse, who earlier criticized the US Army Corps of Engineers’ sole-source contract with Halliburton at a public hearing (see June 27, 2005), is demoted from her position as Principal Assistant Responsible for Contracting (PARC). Greenhouse, who was known for her steadfast adherence to regulations enforcing fair competition, received high performance ratings at the beginning of her tenure, which began in 1997. But after she began objecting to the contracts being awarded to Halliburton subsidiary Kellogg, Brown, & Root (KBR), her reviews became negative. Iraq’s presidential council endorses the final draft of Iraq’s permanent constitution and sends it to the National Assembly. The constitution will be subjected to a referendum vote on October 15 (see October 15, 2005). While the proposed constitution is supported by the Kurdish and Shiite members of the council, the document is bitterly opposed by representatives of the Sunni Arabs, the ethnic Turkomen of northern Iraq, Christians, secular groups, and women. The second article of the constitution declares that Islam is the official state religion, and that it will be regarded as “a main source of legislation.” It also states that “no law can be passed that contradicts the undisputed rules of Islam.” Clerics, therefore, would likely sit on the Supreme Court and would have a role in presiding over family disputes like marriage, divorce, and inheritance. The provision is considered an affront to women’s rights since most interpretations of Islamic law afford women substantially fewer rights than men. Article 25 states that the Iraqi government “shall guarantee the reforming of the Iraqi economy according to modern economic bases, in a way that ensures complete investment of its resources, diversifying its sources and encouraging and developing the private sector.” [Associated Press, 10/12/2005] It marks a significant departure in economic policy from the Baathist government, whose constitution stated that “national resources and basic means of production are owned by the people.” [Constitution of Iraq, 1968]
Article 110, which deals with oil policy, states: “The federal government and the governments of the producing regions and provinces together will draw up the necessary strategic policies to develop oil and gas wealth to bring the greatest benefit for the Iraqi people, relying on the most modern techniques of market principles and encouraging investment.” Observers note that, while this section states that both the federal government and the regional governments will work together, a subsequent clause appears to contradict this. That clause states: “All that is not written in the exclusive powers of the federal authorities is in the authority of the regions. In other powers shared between the federal government and the regions, the priority will be given to the region’s law in case of dispute.” [Associated Press, 10/12/2005]
Article 115 of the constitution would make it possible for provinces to organize themselves as semi-autonomous federal regions, with their own distinct laws. This means, for example, that regions would be able to negotiate contracts with oil companies on their own and exercise control over a bulk of the oil revenue. [Muttitt, 2005] However, the precise division of authority between the central government and any regional governments is not clearly stated in the document. “All that is not written in the exclusive powers of the federal authorities is in the authority of the regions,” the document says. “In other powers shared between the federal government and the regions, the priority will be given to the region’s law in case of dispute.” Most of Iraq’s oil is located in either the Kurdish northern region or the Shiite-dominated south. The Sunnis, who have ruled Iraq almost without interruption since 1920 and whose communities lie predominantly in the resource-poor provinces of central and western Iraq, are opposed to this federalist political structure. The final draft of the constitution is missing an article that had appeared in an earlier draft declaring that it is “forbidden for Iraq to be used as a base or corridor for foreign troops” or “to have foreign military bases in Iraq.” [Asia Times, 10/15/2005]
Author and journalist Melik Kaylan writes an op-ed for the Wall Street Journal advocating the mining of the entire Iraqi border—all 2,250 miles of it. Kaylan writes that if the US turned the entire Iraqi border into a minefield, the Iraqi insurrection could not be replenished with manpower and materiel from Syria and other sources. “Why has nobody publicly debated this idea?” he asks, and says the reason might be “the shock-horror-gasp factor” along with the late Princess Diana’s attempts to ban mines and bad memories of US mining efforts in Vietnam. However, he writes, “once tempers have cooled, it should become clear that of all the unpleasant products of war in Iraq, mining the border offers the least unpleasant.” The 2,250 mines can be laid out according to a strict plan, Kaylan advocates, and removed once hostilities have ended. “The point here is that a precisely ordered minefield is a weapon of peace, rather than war, a deterrent and a stabilizer,” he writes. “When done right, its aim is not to kill or maim but to take a swatch of territory out of the conflict—and to give relief to innocent border-area residents forced, at the point of a gun, to collaborate with infiltrators.” The proposal will not be given serious consideration by US or Iraqi war planners. New York Times foreign affairs columnist Thomas Friedman says: “I think we’re in the end game now.… I think we’re in a six-month window here where it’s going to become very clear and this is all going to pre-empt I think the next congressional election—that’s my own feeling—let alone the presidential one.” Friedman will continue predicting a resolution of the Iraq situation in “the next six months” until at least May 2006 (see May 6-11, 2006). Speaking at the New America Foundation, Colonel Lawrence Wilkerson, the former chief of staff to former Secretary of State Colin Powell, argues that power in Washington has become so concentrated, and the inter-agency processes within the Federal government so degraded, that the government is no longer capable of responding competently to threatening events—whether such events are natural disasters or international conflicts. He describes how successive administrations over the last five decades have damaged the national security decision-making process and warns that new legislation is desperately needed to force transparency on the process and restore checks and balances within the federal bureaucracy. The process has hit a nadir with the Bush administration, he says, whose secrecy and disregard for inter-agency processes has resulted in disastrous policies, such as those toward Iraq, North Korea, and Iran, and the policies that resulted in the prisoner abuse scandal at Abu Ghraib. “Fundamental decisions about foreign policy should not be made in secret,” he says. “You don’t have this kind of pervasive attitude out there unless you’ve condoned it.” He says, “[T]he case that I saw for four-plus years was a case that I have never seen in my studies of aberrations, bastardizations, and perturbations in the national-security [policy-making] process.” This approach to government also contributed to the failures in responding to hurricanes Katrina and Rita. “Decisions that send men and women to die, decisions that have the potential to send men and women to die, decisions that confront situations like natural disasters and cause needless death or cause people to suffer misery that they shouldn’t have to suffer, domestic and international decisions, should not be made in a secret way.” His speech includes a very direct and open attack on the Bush administration. “What I saw was a cabal between the Vice President of the United States, Richard Cheney, and the Secretary of Defense, Donald Rumsfeld, on critical issues that made decisions that the bureaucracy did not know were being made. And then when the bureaucracy was presented with those decisions and carried them out, it was presented in such a disjointed incredible way that the bureaucracy often didn’t know what it was doing as it moved to carry them out.” Wilkerson contrasts the current president with his father, George H.W. Bush, “one of the finest presidents we have ever had,” who, in Wilkerson’s opinion, understood how to make foreign policy work. Wilkerson likens George W. Bush’s brand of diplomacy to “cowboyism” and notes that he was unable to persuade US allies to stand behind his policies because “it’s hard to sell shit.” He explains that Bush is “not versed in international relations and not too much interested in them either. There’s a vast difference between the way George H. W. Bush dealt with major challenges, some of the greatest challenges at the end of the 20th century, and effected positive results in my view, and the way we conduct diplomacy today.” Wilkerson lays the blame for the Abu Ghraib detainee abuse directly at the feet of the younger Bush and his top officials, whom Wilkerson says gave tacit approval to soldiers to abuse detainees. As for Condoleezza Rice, then the national security adviser and now Powell’s successor at the State Department, she was and is “part of the problem.” Instead of ensuring that Bush received the best possible advice even if it was not what Bush wanted to hear, Rice “would side with the president to build her intimacy with the president.” Wilkerson also blames the fracturing and demoralization of the US military on Bush and his officials. Officers “start voting with their feet, as they did in Vietnam,” he says, “and all of a sudden your military begins to unravel.” Wilkerson is particularly scathing in his assessment of the Pentagon’s supervisor of the OSP, Douglas Feith, one of the original members of the Cabal. Asked if he agrees with General Tommy Franks’s assessment of Feith as the “f_cking stupidest guy on the planet.” Wilkerson says, “Let me testify to that. He was. Seldom in my life have I met a dumber man. And yet, after the [Pentagon is given] control, at least in the immediate post-war period in Iraq, this man is put in charge. Not only is he put in charge, he is given carte blanche to tell the State Department to go screw themselves in a closet somewhere.…That’s telling you how decisions were made and…how things got accomplished.” [American Strategy Program, 10/19/2005; Financial Times, 10/20/2005; Inter Press Service, 10/20/2005; Salon, 10/27/2005]
A CIA report completed this month concludes that Saddam Hussein’s Iraq government “did not have a relationship, harbor, or even turn a blind eye toward [Islamist leader Abu Musab] al-Zarqawi and his associates.” The report will be made public one year later as part of a bipartisan Senate investigation. That investigation will conclude that Hussein regarded al-Qaeda as a threat rather as a potential ally, and that the Iraqi intelligence service “actively attempted to locate and capture al-Zarqawi without success.” The New York Times will later report that “The disclosure undercuts continuing claims by the Bush administration that such ties existed, and that they provided evidence of links between Iraq and al-Qaeda.” But despite this report, President Bush will continue to allege such a link existed. For instance, in August 2006, he will claim in a news conference that Hussein “had relations with Zarqawi.” [New York Times, 9/8/2006]
Mother Jones reporter Jack Fairweather and his Iraqi colleague, Aqil Hussein, use tribal records to track down the real Lieutenant General Jamal al-Ghurairy. After 9/11, the Iraqi National Congress prepared an Iraqi defector to pose as al-Ghurairy for a sensational, and false, story claiming that the Hussein regime was training Islamist terrorists (see November 6-8, 2001). The general lives in his home town of Mahmudiya, and meets with the reporters. During their interview, al-Ghurairy grows increasingly angry. He says he never worked at the Salman Pak military installation, where the supposed terrorist training took place, but had been the commandant at the Suwara military base from 1993 until 2000. He says he has never spoken to US intelligence agents or military officials, and until now was unaware that someone had borrowed his identity to disseminate fabrications. “I have never met these people!” he storms. “I have not left Iraq. The people who say this were trying to use my name to make war!” Fairweather notes that he cannot independently verify al-Ghurairy’s identity, writing, “[R]ecords in Iraq are in considerable disarray, and many people have incentive to conceal the truth about their activities before and after the war—former generals are likely high on that list.” But Fairweather was able to corroborate al-Ghurairy’s information with other senior Iraqi officials, who confirmed that the training at the Salman Pak facility was for Iraqi special forces preparing to retake hijacked planes from terrorists. (They do confirm that some foreign fighters were housed at the facility in preparation for the US’s March 2003 invasion.) [Mother Jones, 4/2006]
Three war contractors for KBR, the firm supplying logistical support for US troops in Iraq and Kuwait, meet in a quiet lounge in London’s Cumberland Hotel. The three men are unaware that federal agents are tailing them. They spend the afternoon drinking and discussing the various bribes they have accepted as kickbacks as a routine part of doing business. KBR procurement manager Stephen Seamans, who, unbeknownst to his colleagues, is wearing a wire for the FBI, wonders whether or not he should return $65,000 in bribes his two fellows, executives from the Saudi conglomerate Tamimi Global Co, gave him. One of the two executives, Tamimi operations director Shabbir Khan, tells him to conceal the money by falsifying business records. “Just do the paperwork,” Khan advises. This and other information about KBR war profiteering in Iraq comes from a federal investigation that will begin in late 2007 (see October 2006 and Beyond). In their book The Next Attack, Daniel Benjamin, a fellow at the Center for Strategic and International Studies, and co-author Steven Simon write that neoconservative Laurie Mylroie’s theories about Iraq being behind every terrorist attack on the US since 1993 (see October 2000 and September 12, 2001) are simply unbelievable. They write: “Mylroie’s work has been carefully investigated by the CIA and the FBI.… The more knowledgeable analysts and investigators at the CIA and FBI believe that their work conclusively disproves Mylroie’s claims.” [Unger, 2007, pp. 216]
Dan Senor. [Source: ThinkProgress.org]Fox News analyst Dan Senor, the former spokesman for the Coalition Provisional Authority in Iraq [White House, 10/1/2006; Salon, 5/10/2008] , writes an article for the neoconservative magazine Weekly Standard about the upcoming trial of captured Iraqi ruler Saddam Hussein. Senor writes that the trial will provide “a peek into the depths of human evil and, embarrassingly, if incidentally, into the concurrent indifference of Western nations to Iraqi suffering. Thus far, the accountability of Nuremberg, the Hague, Rwanda, and Sierra Leone has eluded Arab-Muslim leaders. This is about to change.” Senor also says that part of Hussein’s trial strategy will be to attempt to create sympathy for his “humiliation” that will translate into “a spike in the insurgency…” He notes that “an increase in violence is anticipated by Commanding General George Casey too.” [Weekly Standard, 10/2/2005] According to Pentagon documents released as part of the New York Times investigation into the Pentagon propaganda operation surrounding Iraq (see May 9, 2008), Senor routinely asks the advice of Pentagon public relations official Larry Di Rita about what he should say on his television broadcasts, and submits articles such as this to Di Rita for editing directions. Britain accuses Iran of having played a role in the transfer of explosive technology from Hezbollah in Lebanon to the Shia cleric Moqtada al-Sadr’s Mahdi army in Iraq. British officials say Iran is responsible for the deaths of all eight UK soldiers killed in Iraq this year, all of whom died in explosions. Iran denies the charges. The Chicago Tribune publishes a multi-part series titled, “Pipeline to Peril,” summarizing its investigation of the human trafficking network that is supplying US military bases and private contractors in Iraq with cheap labor. The articles detail how Halliburton subsidiaries such as KBR are making use of over 200 illicit international human trafficking brokers for supplying cheap labor for the Iraq war effort, mainly from impoverished Asians. The brokers are often deceitful in their recruiting practices. For instance, they are reported to have promised jobs in luxury hotels in Jordan for the potential workers. The workers are required to pay hefty broker fees up front, and once trapped at halfway points in Jordan by those initial fees, they are informed that that they will be working in Iraq and their passports are confiscated. The article gives an example of twelve Nepalese workers who were kidnapped by Iraqi insurgents at gunpoint and later killed while traveling in an unprotected caravan across Iraq. The New York Times again finds itself apologizing for its failures in covering the outing of Valerie Plame Wilson and its handling, or lack of handling, of the newspaper’s star reporter, Judith Miller, who recently testified as to her knowledge of the matter (see September 30, 2005). It also admits that much of Miller’s prewar reporting on Iraq was “totally wrong.” Although the paper’s publisher, Arthur Sulzberger, and its executive editor, Bill Keller, supported Miller’s decision to go to jail rather than reveal the source of her knowledge about Plame Wilson’s CIA identity (see July 6, 2005), neither knew many details of Miller’s conversations with her source, former White House aide Lewis “Scooter” Libby. Neither knew, for example, that Miller’s claim of not learning Plame Wilson’s identity from Libby was undermined by her own notes. Ultimately, both Sulzberger and Keller left most of the decisions on how to handle the situation to Miller herself. “This car had her hand on the wheel because she was the one at risk,” says Sulzberger. While Miller continues to portray her decision to go to jail as one rooted in principle, critics say that she and the Times were not protecting a whistleblower, but an administration source bent on crushing dissent. Asked what she regretted about the Times’s handling of the matter, managing editor Jill Abramson says, “The entire thing.”
'I Got It Totally Wrong' - Many in the newsroom and in the editorial staff believed that Miller’s prewar articles on Iraq’s WMD—articles that have long been proven to be based largely on false information from unreliable Iraqi defectors (see December 20, 2001, September 18, 2002, March 19-20, 2003, July 25, 2003, and Autumn 2003)—unfairly advanced the administration’s case for war. Miller operated with a level of autonomy other reporters found unusual and distressing, especially since many of them believed her reporting verged on administration propaganda. Investigative editor Douglas Frantz recalls that Miller once called herself “Miss Run Amok”; when he asked her what she meant, she replied, “I can do whatever I want.” Miller now admits her reports were largely specious. “WMD—I got it totally wrong,” she says. “The analysts, the experts, and the journalists who covered them—we were all wrong. If your sources are wrong, you are wrong. I did the best job that I could.”
Not a Clear-Cut Decision to Fight - Keller says: “I wish it had been a clear-cut whistle-blower case. I wish it had been a reporter who came with less public baggage.” Times reporter Todd Purdom says: “Everyone admires our paper’s willingness to stand behind us and our work, but most people I talk to have been troubled and puzzled by Judy’s seeming ability to operate outside of conventional reportorial channels and managerial controls. Partly because of that, many people have worried about whether this was the proper fight to fight.” For her part, Miller says she intends to take some time off and perhaps write a book about her ordeal. She says she wants to get back into investigative reporting, and continue to cover “the same thing I’ve always covered—threats to our country.” [New York Times, 10/16/2005]
Criticism of Miller, Times - The next day, columnist Norman Solomon will write, “It now seems that Miller functioned with more accountability to US military intelligence officials than to New York Times editors.” Solomon also notes that in her July 8, 2003 meeting with White House official Lewis Libby (see 8:30 a.m. July 8, 2003), Miller expressed frustration at the government’s refusal to allow her “to discuss with editors some of the more sensitive information about Iraq.” Solomon writes: “There’s nothing wrong with this picture if Judith Miller is an intelligence operative for the US government. But if she’s supposed to be a journalist, this is a preposterous situation—and the fact that the New York Times has tolerated it tells us a lot about that newspaper.” Solomon also notes that Miller’s claim of “analysts, the experts, and the journalists who covered them” were “all wrong” about Iraqi WMD is itself wrong. “Some very experienced weapons inspectors—including [the chief of the International Atomic Energy Agency] Mohamed ElBaradei, [former chief UN weapons inspector] Hans Blix, and [former UN weapons inspector] Scott Ritter—challenged key assertions from the White House,” he writes. “Well before the invasion, many other analysts also disputed various aspects of the US government’s claims about WMDs in Iraq.… Meanwhile journalists at some British newspapers, including The Independent and The Guardian, raised tough questions that were virtually ignored by mainstream US reporters in the Washington press corps.… [T]he Times did not ‘fall for misinformation’ as much as jump for it. The newspaper eagerly helped the administration portray deceptions as facts.” [CounterPunch, 10/17/2005] Liberal columnist and blogger Arianna Huffington provides a long list of reporters and publications who “didn’t get it wrong” on Iraqi WMD. She quotes reporter Joe Lauria, a veteran foreign affairs reporter who writes for the London Daily Mail, the Daily Telegraph, and the Boston Globe, who told her: “I didn’t get it wrong. And a lot of others who covered the lead up to the war didn’t get it wrong. Mostly because we weren’t just cozying up to Washington sources but had widened our reporting to what we were hearing from people like Mohamed ElBaradei and Hans Blix, and from sources in other countries, like Germany, France, and Russia. Miller had access to these voices, too, but ignored them. Our chief job as journalists is to challenge authority. Because an official says something might make it ‘official,’ but it doesn’t necessarily make it true.” [Huffington Post, 10/21/2005]

The American Civil Liberties Union (ACLU) releases a report that documents the death of 44 detainees in Iraq and Afghanistan while in US custody. Most died during interrogation. The report, based on government reports (including autopsy reports, death reports, and other documents turned over to the ACLU through a Freedom of Information Act request), finds that “detainees were hooded, gagged, strangled, beaten with blunt objects, subjected to sleep deprivation, and to hot and cold environmental conditions.” ACLU director Anthony Romero says: “There is no question that US interrogations have resulted in deaths. High-ranking officials who knew about the torture and sat on their hands and those who created and endorsed these policies must be held accountable. America must stop putting its head in the sand and deal with the torture scandal that has rocked our military.” The detainees died during or after interrogations by Navy SEALs, military intelligence officials, and “OGA” (Other Governmental Agency) personnel, a designation the ACLU says is usually used to refer to the CIA. Twenty-one of the 44 deaths were homicides, the ACLU says. Eight died from abusive techniques; autopsy reports show the causes of death were “strangulation,” “asphyxiation,” and “blunt force injuries.” Most of the “natural deaths” were attributed to what government doctors termed “Arteriosclerotic Cardiovascular Disease.” The ACLU notes that the report proves that detainees died not only at the hands of CIA personnel, but from abuse and maltreatment by Navy SEALs and military intelligence officials as well. The report cites, among other deaths, an Iraqi prisoner who died from hypothermia (see April 5, 2004), an Iraqi prisoner who was strangled and beaten to death (see January 9, 2004), an Iraqi general who died from smothering and “chest compressions” (see November 26, 2003), an Iraqi prisoner beaten and smothered to death (see Between 4:30 a.m. and 5:30 a.m. November 4, 2003), two Afghani civilians beaten to death by US soldiers (see November 6, 2003 and December 10, 2002), and an older Iraqi man strangled to death while in US custody (see June 5, 2003). ACLU lawyer Amrit Singh says: “These documents present irrefutable evidence that US operatives tortured detainees to death during interrogations. The public has a right to know who authorized the use of torture techniques and why these deaths have been covered up.” [American Civil Liberties Union, 10/24/2005]
The media learns that Vice President Dick Cheney and staffers from the Office of the Vice President (OVP) regularly interfered with the Senate Intelligence Committee’s 2004 report on the intelligence community’s failures to accurately assess Iraq’s WMD threat (see July 9, 2004). According to administration and Congressional sources, that interference was facilitated and encouraged by committee chairman Pat Roberts (R-KS). Cheney and the OVP members regularly intervened in the committee’s deliberations, and drastically limited the scope of the investigation.
Protecting the Bush Administration - Reporter Laura Rozen will later write, “In order to prevent the White House and the Office of the Vice President itself from ever coming under any Congressional oversight scrutiny, Cheney exerted ‘constant’ pressure on [Roberts] to stall an investigation into the Bush administration’s use of flawed intelligence on Iraq.” Cheney and the OVP also withheld key documents from the committee. Some of the withheld materials included portions of then-Secretary of State Colin Powell’s February 2003 address to the United Nations (see February 5, 2003) that were written by Cheney’s then-chief of staff, Lewis Libby, and documents that Libby used to make the administration’s case for war with Iraq. The OVP also withheld the Presidential Daily Briefing (PDB) documents: written intelligence summaries provided to President Bush by the CIA. The decision to withhold the documents was spearheaded by Cheney’s chief legal counsel and chief of staff David Addington. Much of the withheld material, and Cheney-OVP interference, was designed to keep the committee from looking into the Bush administration’s use of intelligence findings to promote the war. According to committee member John D. Rockefeller (D-WV), Cheney attended regular policy meetings in which he gave White House orders to Republican committee staffers. It is “not hearsay,” Rockefeller says, that Cheney pushed Roberts to, in reporter Jonathan Landay’s words, “drag out the probe of the administration’s use of prewar intelligence.” The committee chose to defer the second portion of its report, about the administration’s use of intelligence to propel the nation to war, until after the November 2004 elections. That portion of the report remains uncompleted.
Shifting the Blame to the White House - Reporter Murray Waas writes, “Had the withheld information been turned over, according to administration and Congressional sources, it likely would have shifted a portion of the blame away from the intelligence agencies to the Bush administration as to who was responsible for the erroneous information being presented to the American public, Congress, and the international community.” He continues: “When the [report] was made public, Bush, Cheney, and other administration officials cited it as proof that the administration acted in good faith on Iraq and relied on intelligence from the CIA and others that it did not know was flawed. But some Congressional sources say that had the committee received all the documents it requested from the White House the spotlight could have shifted to the heavy advocacy by Cheney’s office to go to war. Cheney had been the foremost administration advocate for war with Iraq, and Libby played a central staff role in coordinating the sale of the war to both the public and Congress.” [National Journal, 10/27/2005; Wilson, 2007, pp. 381]

In light of the indictment of Lewis “Scooter” Libby (see October 28, 2005), the Center for American Progress (CAP) puts out an analysis of Libby’s role as Vice President Dick Cheney’s chief of staff, and the impact Libby has had on Bush administration policies. Libby, a powerful and influential neoconservative, “has been one of the most important men pulling the levers behind the Bush administration,” the article finds. “From the very beginning of the administration, Libby has essentially been Dick Cheney’s Dick Cheney.” But, the article goes on to note: “[w]hat few have realized at this historic moment is that for the past four and a half years, Libby has been ‘scooting’ from scandal to scandal. Libby has been at center stage for the other major national security scandals of the Bush administration, including the Iraq intelligence debacle, the secret meetings about Halliburton contracts, and doubtless others we have not heard of yet. It was Libby—along with Paul Wolfowitz, Doug Feith, and a handful of other top aides at the Pentagon and White House—who convinced the president that the US should go to war in Iraq. It was Libby who pushed Cheney to publicly argue that Saddam Hussein had ties to al-Qaeda and 9/11. It was also Libby who prodded former Secretary of State Colin Powell to include specious reports about an alleged meeting between 9/11 terrorist Mohamed Atta and an Iraqi intelligence official in Powell’s February 2003 speech to the United Nations” (see February 5, 2003). Libby co-authored the controversial Defense Planning Guidance document of 1988 (see February 18, 1992) that called on the US to essentially transform itself into an aggressive empire, using its military to stretch its power around the world. “This Planning Guidance document went a long way toward endearing Libby to Cheney,” the CAP article reads. There is also evidence that Libby helped steer no-bid Iraqi reconstruction contracts to Cheney’s former firm, Halliburton. The article concludes, “Given the depth of his influence in shaping the White House agenda over the past four and a half years, losing Libby today is not only a huge blow to the vice president, but to the entire Bush administration.” [Center for American Progress, 10/28/2005]
