Israeli prime minister Ariel Sharon makes a formal state visit to India, to recognize and expand the strong military and security ties that are developing between the two states. Concern in respect to Israeli military tactics including targeted assassinations and the use of overwhelming force against civilians are voiced in some quarters. Concern is also voiced about damage to India’s standing in the Arab world. [FrontPage Magazine, 9/13/2003] There are reports that an agreement to conduct joint military excercises involving Indian and Israeli elite special forces has been reached, although neither government confirms this. [Jewish Telegraph Agency, 9/26/2003]
In a speech to the nation commemorating the second anniversary of the 9/11 attacks, President Bush promises that no more troops are needed in Iraq. The 130,000 currently deployed are enough to handle the mission, he says. Besides, “now some 60,000 Iraqi citizens under arms, defending the security of their own country, are now active, with more coming.” The Iraqi Governing Council, which he calls “25 leaders representing Iraq’s diverse people,” is almost ready to take over governance of their country (see September 8, 2003), Bush says. Viewership for the speech is half the number of people who watched Bush’s January State of the Union address (see 9:01 pm January 28, 2003), and polls indicate that support for the Iraqi occupation is sagging among Americans. [Rich, 2006, pp. 102-103]
Under pressure from the United States and European countries, the 35-member governing board of the International Atomic Energy Agency (IAEA) passes a strongly worded resolution requiring Iran to comply with a number of demands related to its nuclear program by October 31. The action is spurred in part by a recent discovery of traces of highly enriched, weapons-grade uranium at an Iranian nuclear facility. The resolution—sponsored by Australia, Canada, and Japan—states that Iran must suspend all uranium enrichment activities, submit a full declaration of all imported material for its uranium enrichment program, and grant IAEA inspectors unfettered access to all its facilities. Iran must also “promptly and unconditionally” agree to an additional protocol that would give IAEA inspections more access than currently required by the Nuclear Non-Proliferation Treaty (NPT). [International Atomic Energy Agency. Board of Governors., 9/12/2003 ; Associated Press, 9/13/2003; China Daily, 9/13/2003; Daily Telegraph, 9/13/2004] The US, which has long argued that Iran has a secret nuclear weapons program, said in a statement before the resolution was passed that it believed “the facts already established by the agency about Iran’s nuclear program would fully justify an immediate finding of non-compliance by Iran with its safeguards obligations.” A finding of non-compliance would bring the issue before the UN Security Council, which could then levy sanctions on Iran. The other members of the board disagreed with the US position, instead arguing in favor of giving Iran “a last chance.” [US Department of State, 9/12/2003; Associated Press, 9/13/2003] After the passing of the resolution, the Iranian delegation storms out in protest. Iran’s ambassador to the United Nations in Vienna, Ali Akbar Salehi, issues a veiled threat that Iran might withdraw from the NPT. “We will have no choice but to have a deep review of our existing level and extent of engagement with the agency vis-a-vis this resolution,” he says. He also states, “It is no secret that the current US administration… entertains the idea of invasion of yet another territory as they aim to re-engineer and reshape the entire Middle East region.” [Associated Press, 9/13/2003] In Washington, a US official tells Reuters, “This time we hope there’s not going to be a way to escape because this resolution is really tightening the noose on them.” If Iran is declared in non-compliance, the official adds, “Iran will forfeit its right to share nuclear technology for peaceful purposes” and Russia will not be able to provide nuclear fuel for Iran’s Bushehr nuclear plant. [China Daily, 9/13/2003]
The legal experts at the Office of the Staff Judge Advocate (OSJA) issue a memorandum amending the set of interrogation rules included in a September 10 memo (see September 10, 2003) by military legal experts in Iraq. The additional methods included in that memo can only be used with prior approval by Lieutenant General Ricardo Sanchez on a case-by-case basis, the OSJA document says. [US Department of Defense, 8/23/2004 ] Like Major General Geoffrey Miller, the OSJA stresses the importance of collaboration between MPs and intelligence personnel. It also provides “safeguards such as legal reviews of the interrogation plans and scrutiny of how they were carried out,” the Washington Post later reports. [Washington Post, 6/12/2004] Additionally, the memo discusses how the Arab fear of dogs can be exploited. [US Department of Defense, 8/23/2004 ] According to a later report (see August 25, 2004) by General George R. Fay, interrogators at Abu Ghraib immediately adopt the new set of rules. But Staff Judge Advocate Colonel Mark Warren will recall that the memo is not implemented until its approval by the US Central Command (CENTCOM). [US Department of Defense, 8/23/2004 ] Evidence, however, supports the Fay report. “After mid-September 2003,” Fay will write, “all [s]oldiers assigned to Abu Ghraib had to read a memorandum titled IROE [Interrogations Rules of Engagement], acknowledging they understood the ICRP, and sign a confirmation sheet indicating they had read and understood the ICRP.” [US Department of Defense, 8/23/2004 ] According to classified documents uncovered by the Senate Armed Services Committee (see April 21, 2009), CENTCOM lawyers begin objecting to the policies almost immediately. One e-mail, from a CENTCOM lawyer to a Staff Judge Advocate, warns, “Many of the techniques appear to violate [Geneva Conventions] III and IV and should not be used.” [Huffington Post, 4/21/2009]

Polls in predominantly Arab and Muslim nations show anti-American sentiments are steadily rising despite the US’s advertising efforts. (In many of these nations, Osama bin Laden has higher favorability ratings than President Bush.) The GAO report finds numerous reasons for this widespread failure. Among them are:
The State Department’s scattershot, uncoordinated efforts;
Foreign service officers charged with promoting America’s image spend too much time on paperwork, and 20 percent of those officers do not fluently speak the language of the country in which they are stationed;
The US government’s failure to not scientifically measure the effects of its public relations programs, instead relying on anecdotal evidence. [USA Today, 9/15/2003]
Senator Richard Lugar (R-IN), chairman of the Senate Foreign Relations Committee, is at a loss to explain the problem. “Americans are brilliant at communication,” he says. “Why in the world we are all thumbs in this particular area just strikes me as one of the anomalies of history. But it’s an important one to solve pretty fast.” The State Department’s first Undersecretary for Public Diplomacy, Charlotte Beers (see October 2, 2001), resigned in March for what the administration called “health reasons,” and has not yet been replaced. Beers is responsible for the failed “Shared Values” program, which relied on commercially slick video reports to sway Muslim and Arab public opinion (see Late October, 2002). [New York Times, 3/3/2003; USA Today, 9/15/2003; Center for Media and Democracy, 10/17/2007] Beers’s biggest success may have been Radio Sawa, an American radio station broadcasting throughout much of the Middle East that broadcasts US-based pop music, with 10-minute news broadcasts every hour from American government sources. [USA Today, 9/15/2003]
Private Alyssa Peterson. [Source: Arizona Daily Sun]Private Alyssa Peterson, deployed as an Arabic-speaking interrogator in Iraq, commits suicide rather than participate in torturing Iraqi prisoners. Peterson, from Flagstaff, Arizona, serves with the 311th Military Intelligence Unit, a part of the 101st Airborne, at an American air base in Tal Afar. Her death is initially cited as an accident resulting from a “non-hostile weapons discharge,” a not uncommon citation. Shortly after her death, Army officials tell the Arizona Republic that “a number of possible scenarios are being considered, including Peterson’s own weapon discharging, the weapon of another soldier discharging, or the accidental shooting of Peterson by an Iraqi civilian.” In 2005, reporter Kevin Elston will probe more deeply into Peterson’s death; documents released under the Freedom of Information Act will show that, according to Elston’s report for radio station KNAU: “Peterson objected to the interrogation techniques used on prisoners. She refused to participate after only two nights working in the unit known as the cage. Army spokespersons for her unit have refused to describe the interrogation techniques Alyssa objected to. They say all records of those techniques have now been destroyed.” Official records show that Peterson had been “reprimanded” for showing “empathy” for the prisoners. The report of her death states, “She said that she did not know how to be two people; she… could not be one person in the cage and another outside the wire.” She was reassigned to gate duty, and sent to suicide prevention training, but, the report reads, “[O]n the night of September 15th, 2003, Army investigators concluded she shot and killed herself with her service rifle.” A notebook is found next to her body, but its contents are entirely redacted. Peterson also leaves a suicide note, which Elston will be unable to obtain. After reviewing the records documenting the circumstances of her death, Elston will say: “The reactions to the suicide were that she was having a difficult time separating her personal feelings from her professional duties. That was the consistent point in the testimonies, that she objected to the interrogation techniques, without describing what those techniques were.” Peterson’s parents will not be told of their daughter’s suicide for three years, but are told merely that she died as a result of an accident. [Huffington Post, 4/24/2009] In 2009, reporter and author Greg Mitchell will interview former Sergeant Kayla Williams, an Army interpreter who served briefly with Peterson at Tal Afar. Williams, like Peterson, objected to abusive techniques being used on prisoners, and is eventually transferred to different duties (see Late September 2003). Williams will note that there are probably more factors involved in Peterson’s suicide than her revulsion to torture. “It’s always a bunch of things coming together to the point you feel so overwhelmed that there’s no way out,” Williams will say. “I witnessed abuse, I felt uncomfortable with it, but I didn’t kill myself, because I could see the bigger context. I felt a lot of angst about whether I had an obligation to report it, and had any way to report it. Was it classified? Who should I turn to?… It also made me think, what are we as humans, that we do this to each other? It made me question my humanity and the humanity of all Americans. It was difficult, and to this day I can no longer think I am a really good person and will do the right thing in the right situation.” Mitchell will write, “Such an experience might have been truly shattering to the deeply religious Peterson.” [Huffington Post, 4/24/2009]
Victoria “Torie” Clarke, the Pentagon’s former public relations secretary who developed the Pentagon’s Iraq propaganda operation (see May 2001), joins CNN as a political and policy analyst. Her propaganda operation relied on retired military officers to serve as network analysts, promoting the administration’s Iraq policies and touting the occupation as a success. [New York Times, 9/23/2003] Several months later, Clarke will also join Comcast Communications, the nation’s largest cable television corporation, as its senior adviser for communications and government affairs. [PRWatch, 12/15/2003]
The US administrator for Iraq, L. Paul Bremer, speaks with President Bush during a dinner party. Discussing the insurgency in Iraq, Bremer warns Bush, “We’re up against a growing and sophisticated threat.” In his 2006 book My Year in Iraq, Bremer will write that at this time, the US only has “about half the number of soldiers we need… here.” [New York Times, 4/20/2008]
Representatives Porter Goss (R-FL) and Jane Harman (D-CA) of the House Permanent Select Committee on Intelligence send a letter to CIA Director George Tenet, criticizing his agency for providing poor intelligence on Iraq during the months leading up to the invasion of Iraq. They were prompted to write the letter after spending “four months combing through 19 volumes of classified material” and discovering how poorly the evidence supported the White House’s assertions about Iraq. Bush administration officials downplay the charges. In the letter, they say the CIA provided intelligence based on “circumstantial,” “fragmentary,” and ambiguous evidence. “Thus far, it appears that these judgments were based on too many uncertainties,” they note in their letter. [Washington Post, 9/28/2003; Reuters, 9/29/2003]
Outdated, 'Piecemeal' Intelligence Used - They also accuse the CIA of using intelligence that was outdated, including assessments dating back to 1998 when the UN was forced to leave Iraq ahead of US bombing. Evidence that was recent often consisted of “piecemeal” intelligence. “Intelligence assessments that Iraq continued to pursue chemical and biological weapons… were long-standing judgments,” which “remained constant and static over the past ten years,” they complain in the letter. 'Absence of Proof' - Another criticism they have is that the intelligence agency sometimes drew conclusions based on faulty logic. “The absence of proof that chemical and biological weapons and their related development programs had been destroyed was considered proof that they continued to exist,” they say. [Washington Post, 9/28/2003; Reuters, 9/29/2003]
Dubious Sources - Lastly, they complain that the CIA uncritically accepted claims from dubious sources. In the agency’s assessments, it failed to clarify which reports “were from sources that were credible and which were from sources that would otherwise be dismissed in the absence of any other corroborating intelligence.” [Washington Post, 9/28/2003]
No 'Definitive' Intelligence - Significantly, the authors assert, “We have not found any information in the assessments that are still classified that was any more definitive.” [Washington Post, 9/28/2003]
White House Ignores Criticism - The White House dismisses the criticisms.
The neoconservative American Enterprise Institute hosts Hossein Khomeini, grandson of the Ayatollah Ruhallah Khomeini. Khomeini leads a discussion on Iran’s future at the Wohlstetter Conference Center in Washington DC. He is introduced by Michael Ledeen. Both Khomeini and the AEI advocate the overthrow of Iran’s ruling mullahs by the US. [American Enterprise Institute, 9/26/2003]
Shortly after the FBI launches its investigation into the Plame Wilson leak (see September 26, 2003), White House political strategist Karl Rove assures President Bush that he had no involvement in leaking Valerie Plame Wilson’s CIA identity to the press (see July 8, 2003 and 11:00 a.m. July 11, 2003). Rove also assures Bush that he had nothing to do with leaking information to the press concerning Plame Wilson’s husband, war critic Joseph Wilson. He does not tell Bush about his July 2003 conversation with Time magazine reporter Matthew Cooper, in which he identified Plame Wilson as a CIA agent, nor does he tell him that he told Cooper that Plame Wilson had arranged for her husband to go to Niger (see February 19, 2002, July 22, 2003, and October 17, 2003). According to a 2005 story in the National Journal, Rove will also fail to disclose this information in his upcoming interviews with FBI investigators. Because of Rove’s assurances, Bush will tell White House press secretary Scott McClellan that he vouches for Rove’s non-involvement in the Plame Wilson affair (see September 29, 2003), and will give special prosecutor Patrick Fitzgerald the same assurances (see June 24, 2004). The Washington Post publishes an article stating that in July, two White House officials had leaked the name and CIA employment status of Valerie Plame Wilson to at least six reporters, and told the reporters that Plame Wilson had been responsible for sending her husband to Niger (see June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, 8:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, 1:26 p.m. July 12, 2003, and July 12, 2003). The article is based on a leak of information by a “senior administration official.” Such an explosive leak is relatively rare from the Bush administration. Reporters Mike Allen and Dana Priest report, “It is rare for one Bush administration official to turn on another.” Asked about the motive for describing the leaks, the senior official says the leaks of Plame Wilson’s identity were “[c]learly… meant purely and simply for revenge.” The leaks were “wrong and a huge miscalculation, because they were irrelevant and did nothing to diminish [Joseph] Wilson’s credibility.” [Washington Post, 9/28/2003; Truthout (.org), 4/14/2006] The “senior administration official” will later be revealed to be State Department official Marc Grossman (see May 29, 2003, June 10, 2003, 12:00 p.m. June 11, 2003, and October 17, 2003). '1x2x6' Theory - Author and blogger Marcy Wheeler, covering the Plame Wilson leak and the subsequent perjury trial of Lewis Libby (see October 28, 2005) for the blogs The Next Hurrah and later Firedoglake, later writes that the Allen/Priest report states the “1x2x6 theory” of the leak, in which one anonymous source tells Allen and Priest that two senior White House officials called at least six Washington reporters to discuss Plame Wilson’s CIA status. Wheeler will note that one of those Washington reporters, Robert Novak, has denied being the White House’s “willing pawn” who leaked Plame Wilson’s identity when the other reporters refused (see July 14, 2003, September 29, 2003, and October 1, 2003). Wheeler will write, “Novak’s October 1 column was designed to refute the incredibly damaging quotes from the 1x2x6 source that clearly indicated the leak was planned.” She will speculate that the single anonymous source for Allen and Priest may be Secretary of State Colin Powell, but she will state that she is by no means sure, and has no proof of her speculation. Poor Reasoning - Wilson will later write that he is pleased to learn that “there was at least one Bush official who believed the conduct of his colleagues was ‘wrong.’ I was disappointed to read that he or she evidently judged it so not because it was a betrayal of national security but because it was beside the point and had done nothing to damage my credibility. Would the leak have been okay if it had really impeached my character and sent me skittering into some dungeon reserved for critics of the Bush administration?”
'Smear Campaign' Readied Well before Wilson Published Op-Ed - Wilson muses over the implications of the article. He concludes that if two White House officials had conducted such a large media campaign, “there must have been a meeting to decide on the action to take” (see June 2003). And because of the timing, the officials involved must have had the information on Plame Wilson “well before the appearance of my article on Sunday, July 6” (see July 6, 2003). How did the two officials learn of his wife’s status? he wonders. Was there a breach of security? Was the revelation of his wife’s identity inadvertent or deliberate? “Whatever the answers to these questions,” he will write, “I knew for certain that the initial disclosure of her status, whether deliberate or inadvertent, was the first damaging act, before the calls to all the journalists were placed.… [A] plan to attack me had been formed well before [the publication of his editorial]. It was cocked and ready to fire as soon as I crossed the trip wire and wrote about what I hadn’t found in Niger. My [editorial] triggered the attack, but I was not the only target of it. Now my wife was in their sights, as well. What then happened was not a case of the loose lips of an overly ardent junior defender of the administration flapping to one reporter, but an organized smear campaign directed from the highest reaches of the White House. A group of supposed public servants, collecting salaries paid by American taxpayers and charged with defending the national security of the country, had taken it upon itself to attack me by exposing the identity of a member of the CIA’s clandestine service, who happened to be my wife. Revenge and intimidation had been deemed more important than America’s national security for these co-conspirators.” [Wilson, 2004, pp. 385-387]

Kayla Williams. [Source: Bowling Green State University]Sergeant Kayla Williams, an Army interpreter, witnesses prisoners being abused while being detained in Mosul. Williams is troubled by the death of an acquaintance, Private Alyssa Peterson, who actually committed suicide rather than take part in the torture of prisoners (see September 15, 2003 and After). Williams witnesses an incident that closely parallels the kind of interrogation Peterson objected to. She is taken into a special holding area called “the cage,” where she sees US soldiers punching a naked detainee in the face and burning him with lit cigarettes. There is no interrogation, just the brutalization of a prisoner. Williams will later write: “It’s one thing to make fun of someone and attempt to humiliate him. With words. That’s one thing. But flicking lit cigarettes at somebody—like burning him—that’s illegal.” She will later write that soldiers will soon tell her that “the old rules no longer applied because this was a different world. This was a new kind of war.” In 2005, Williams will recall the incident on CNN: “I was asked to assist. And what I saw was that individuals who were doing interrogations had slipped over a line and were really doing things that were inappropriate. There were prisoners that were burned with lit cigarettes. They stripped prisoners naked and then removed their blindfolds so that I was the first thing they saw. And then we were supposed to mock them and degrade their manhood. And it really didn’t seem to make a lot of sense to me. I didn’t know if this was standard. But it did not seem to work. And it really made me feel like we were losing that crucial moral higher ground, and we weren’t behaving in the way that Americans are supposed to behave.” After that session and several others that same day, she tells a superior officer that she will not take part in future interrogations. “I sat through it at the time,” she will recall. “But after it was over I did approach the non-commissioned officer in charge and told him I think you may be violating the Geneva Conventions.… He said he knew and I said I wouldn’t participate again and he respected that, but I was really, really stunned.” In 2009, Williams will say: “In general, interrogation is not fun, even if you follow the rules. And I didn’t see any good intelligence being gained. The other problem is that, in situations like that, you have people that are not terrorists being picked up, and being questioned. And, if you treat an innocent person like that, they walk out a terrorist.” [Huffington Post, 4/24/2009]
Fox analyst Paul Vallely. [Source: The Intelligence Summit]The Pentagon sends a group of retired military generals and other high-ranking officers—part of its team of “independent military analysts” (see April 20, 2008 and Early 2002 and Beyond) on a carefully arranged tour of Iraq (see Summer 2003). The idea is to have the analysts counter the negative images being reported from Iraq about the upsurge in violence from the burgeoning insurgency. The Pentagon also wants the analysts to present a positive spin on Iraq in time to bolster President Bush’s request to Congress for $87 billion in emergency war financing. The group includes four analysts from Fox News, the Pentagon’s go-to media outlet for promulgating its propaganda and spin, one analyst from CNN and ABC, and several prominent members of research groups whose opinion articles appear regularly in the editorial pages of the largest US newspapers. The Pentagon promises that the analysts will be given a look at “the real situation on the ground in Iraq.”
Two Very Different Views of Reality - While the situation is rapidly deteriorating for the US—the American administrator, L. Paul Bremer, later writes that the US only has “about half the number of soldiers we needed here,” and has told Bush, “We’re up against a growing and sophisticated threat” at a dinner party that takes place on September 24, while the analysts are in Iraq (see September 24, 2003)—the story promoted by the analysts is starkly different. Their official presentation as constructed on a minute-by-minute basis by Pentagon officials includes a tour of a model school, visits to a few refurbished government buildings, a center for women’s rights, a mass grave from the early 1990s, and a tour of Babylon’s gardens. Mostly the analysts attend briefings, where one Pentagon official after another provide them with a very different picture of Iraq. In the briefings, Iraq is portrayed as crackling with political and economic energy. Iraqi security forces are improving by the day. No more US troops are needed to combat the small number of isolated, desperate groups of thugs and petty criminals that are spearheading the ineffective insurgency, which is perpetually on the verge of being eliminated. “We’re winning,” a briefing document proclaims. ABC analyst William Nash, a retired general, later calls the briefings “artificial,” and calls the tour “the George Romney memorial trip to Iraq,” a reference to former Republican governor George Romney’s famous claim that US officials had “brainwashed” him into supporting the Vietnam War during a tour there in 1965. Yet Nash, like the other analysts, will provide the talking points the Pentagon desires to his network’s viewers. Pentagon officials worry, for a time, about whether the analysts will reveal the troubling information they learn even on such a well-groomed and micromanaged junket, including the Army’s use of packing poorly armored Humvees with sandbags and Kevlar blankets, and the almost laughably poor performance of the Iraqi security forces. One Fox analyst, retired Army general Paul Vallely, later says, “I saw immediately in 2003 that things were going south.” But the Pentagon has no need to worry about Vallely or any of the other analysts. “You can’t believe the progress,” Vallely tells Fox News host Alan Colmes upon his return. Vallely predicts that the insurgency would be “down to a few numbers” within months. William Cowan, a retired Marine colonel, tells Fox host Greta Van Susteren, “We could not be more excited, more pleased.” Few speak about armor shortages or poor performances by Iraqi security forces. And all agree with retired general Carlton Shepperd’s conclusion on CNN: “I am so much against adding more troops.”
'Home Run' - The Iraq tour is viewed as what reporter David Barstow will call “a masterpiece in the management of perceptions.” Not only does it successfully promote the administration’s views on Iraq, but it helps fuel complaints that “mainstream” journalists are ignoring what administration officials and war supporters call “the good news” in Iraq. “We’re hitting a home run on this trip,” a senior Pentagon official says in an e-mail to the chairman and vice chairman of the Joint Chiefs of Staff, Richard Myers and Peter Pace. The Pentagon quickly begins planning for future trips, not just to Iraq but to Afghanistan and Guantanamo Bay (see June 24-25, 2005) as well. These trips, and the orchestrated blitz of public relations events that follow, are strongly supported by the White House.
Countering 'Increasingly Negative View' of Occupation - Pentagon spokesman Lawrence Di Rita will later explain that a “conscious decision” was made to use the analysts to counteract what Di Rita calls “the increasingly negative view of the war” coming from journalists in Iraq. The analysts generally have “a more supportive view” of the administration and the war; and the combination of their military expertise and their tremendous visibility make them ideal for battling what Di Rita and other Pentagon and administration see as unfairly negative coverage. On issues such as troop morale, detainee interrogations, inadequate equipment, and poorly trained Iraqi forces, Di Rita will say the analysts “were more likely to be seen as credible spokesmen.”
Business Opportunities - Many of the analysts are not only in Iraq to take part in the Pentagon’s propaganda efforts, but to find out about business opportunities for the firms they represent. They meet with civilian and military leaders in Iraq and Kuwait, including many who will make decisions about how the $87 billion will be spent. The analysts gather inside information about the most pressing needs of the US military, including the acute shortage of “up-armored” Humvees, the billions needed to build new military bases, the dire shortage of translators, and the sprawling and expensive plans to train Iraqi security forces. Analysts Cowan and Sherwood are two of the analysts who have much to gain from this aspect of their tour. Cowan is the CEO of a new military firm, the wvc3 Group. Sherwood is the executive vice president of the firm. The company is seeking contracts worth tens of millions of dollars to supply body armor and counterintelligence services in Iraq. The company has a written agreement to use its influence and connections to help Iraqi tribal leaders in Al-Anbar province win reconstruction contracts from the Americans. “Those sheiks wanted access to the CPA,” Cowen later recalls, referring to the Coalition Provisional Authority. And he is determined to provide that access. “I tried to push hard with some of Bremer’s people to engage these people of Al-Anbar,” he recalls. Fox military analyst Charles Nash, a retired Navy captain, works as a consultant for small companies who want to land fat defense contracts. As a military analyst, he is able to forge ties with senior military leaders, many of whom he had never met before. It is like being “embedded” with the Pentagon leadership, he will recall. He will say, “You start to recognize what’s most important to them…. There’s nothing like seeing stuff firsthand.” An aide to the Pentagon’s chief of public relations, Brent Krueger, will recall that he and other Pentagon officials are well aware of their analysts’ use of their access as a business advantage. Krueger will say, “Of course we realized that. We weren’t naïve about that…. They have taken lobbying and the search for contracts to a far higher level. This has been highly honed.” (Di Rita will deny ever thinking that analysts might use their access to their business advantage, and will say that it is the analysts’ responsibility to comply with ethical standards. “We assume they know where the lines are,” he will say.) National Security Adviser Condoleezza Rice, frustrated with Coalition Provisional Authority (CPA) administrator L. Paul Bremer’s lack of cooperation and coordination with her office (see September 8, 2003 and December 2003 and After), forms the Iraq Stabilization Group (ISG) to oversee Bremer and settle disputes between the Defense and State Departments in governing Iraq. [Roberts, 2008, pp. 130] According to unnamed White House officials, the ISG originated with President Bush’s frustration at the lack of progress in both Iraq and Afghanistan. “The president knows his legacy, and maybe his re-election, depends on getting this right,” says an administration official. “This is as close as anyone will come to acknowledging that it’s not working.” Defense Department officials deny that the ISG is designed to take power away from Defense Secretary Donald Rumsfeld: “Don recognizes this is not what the Pentagon does best, and he is, in some ways, relieved to give up some of the authority here,” says one senior Pentagon official. In reality, both Rumsfeld and Secretary of State Colin Powell are giving up some control over the reconstruction efforts to the White House, specifically to the National Security Council. Rice will oversee four coordinating committees, on counterterrorism efforts, economic development, political affairs in Iraq and media messaging. One of her deputies will run each committee, assisted by undersecretaries from State, Defense, and the Treasury Department, as well as representatives from the CIA. The counterterrorism committee will be run by Frances Fragos Townsend; the economic committee by Gary Edson; the political affairs committee by Robert Blackwill; and the communications committee by Anna Perez. [New York Times, 10/6/2003] In May 2004, the Washington Post will report that the ISG is dysfunctional and ineffective almost from the outset; within months, all but Blackwill have been reassigned (Perez will leave Washington for a job with NBC), and a search of the White House Web site will find no mention of the ISG later than October 2003. Robin Cook (see March 17-18, 2003) publishes portions of a diary he had kept when he was Tony Blair’s foreign minister. The published memoirs reveal—among other things—that Blair had intentionally misled the British population. [Sunday Times (London), 10/5/2003; Guardian, 10/6/2003; Cook, 8/2/2004] The diary reveals how before the war intelligence provided to Cook by British intelligence chief John Scarlett indicated that Saddam Hussein probably did not have weapons of mass destruction that could be used to attack the US or Britain. [Sunday Times (London), 10/5/2003; Guardian, 10/6/2003; Cook, 8/2/2004] Cook’s entries also show that before the war, Blair did not believe that Iraq had weapons of mass destruction that could be used to attack the US or Britain. [Sunday Times (London), 10/5/2003; Guardian, 10/6/2003; Cook, 8/2/2004] Additionally, the diary shows that Tony Blair ignored the “large number of ministers who spoke up against the war.” He says that the officials in the foreign ministry were consistently opposed to the invasion of Iraq. In a speech, former National Security Adviser Zbigniew Brzezinski observes that in 1963, during the Cuban missile crisis between the US and the USSR, Secretary of State Dean Acheson offered to show French President Charles de Gaulle satellite photographs of Soviet missiles in Cuba to support President Kennedy’s request for French support in case the US needed to go to war with the US. De Gaulle replied that he did not need to see the photos, that Kennedy’s word was good enough for him. In April 2004, former ambassador Joseph Wilson, reflecting on Brzezinski’s words and the raft of lies and misinformation that led the US to invade and occupy Iraq, will write, “Who would now ever take an American president at his word, in the way that de Gaulle once did?” [Wilson, 2004, pp. 426]
Senior CIA case officer Valerie Plame Wilson testifies to the Senate Intelligence Committee as part of its investigation into the failures and possible misuse of intelligence in the run-up to the Iraq invasion (see July 9, 2004). In 2007, Plame Wilson will write that she and her husband hope that the committee will “reveal how the administration cherry-picked intelligence to justify going to war with Iraq [and] show that the decision to go to war was premature; the intelligence community simply did not have the hard evidence from current, reliable human sources to match the confident rhetoric coming from the White House and its supporters.” Plame Wilson is accompanied in her appearance before the committee by a CIA attorney, whose job is to represent the agency’s interests, not hers. She is not questioned by any senators, but by four young staffers, two Democrats and two Republicans. When the staffers begin asking her about the story of the Iraq-Niger uranium connection and how she learned about it, it becomes obvious to her, as she will recall in her 2007 book Fair Game, that they “knew very little about how CIA cover actually worked, yet they acted as if they were veterans of the intelligence community.” One aggressive Republican staffer asks why she recommended her husband, former ambassador Joseph Wilson, to go to Niger to investigate the uranium allegations (see February 13, 2002); Plame Wilson will recall, “In my desire to be as accurate and truthful as possible, I answered, stupidly, ‘I don’t believe that I recommended my husband, but I can’t recall who suggested him for the trip.” She fails to recall that a CIA records officer actually recommended her husband for the trip (see February 19, 2002). She also forgets during the interrogation that it was a phone call from Vice President Dick Cheney’s office that set the entire trip into motion (see (February 13, 2002)). And she forgets that it was her branch supervisor who asked that Wilson come in to the CIA to discuss the possibility of such a trip (see February 19, 2002). She does recall staying out of the initial CIA interview with her husband. In 2007, she will blame her memory failures on her own lack of composure, her lack of preparation for the interview, and her refusal to compare memories with her husband out of a sense of propriety. After 45 minutes or so, she leaves the interview, fairly sure that she handled herself well, but with “a little voice in my head [saying] it felt like a setup.” She will write: “In retrospect, it was clear they weren’t seeking information, but simply confirming their already closed conclusions. But in my naivete, my heart actually felt light because I believed in our democratic institutions. I believed that the truth would prevail, but I would soon find out that in Washington, the truth is not always enough.” [Wilson, 2007, pp. 167-169]
The media begins probing as to whether Vice President Dick Cheney’s chief of staff, Lewis Libby, was involved in the Plame Wilson leak. CBS correspondent John Roberts asks White House press secretary Scott McClellan: “You said the other day, emphatically, that you have received assurances from Karl Rove that he had nothing to do with this (see September 16, 2003, September 27, 2003, and September 29, 2003). Have you since received similar assurances from the vice president’s chief of staff?” McClellan attempts to finesse the question, replying, “I’m not going to go down a list of every single member of the staff of the White House.” Roberts retorts, “That’s just one name.” After the gaggle, McClellan runs into Libby, and warns him that his name is beginning to surface in connection with the leak. McClellan reiterates his answer to Roberts, and says: “Now that there’s an investigation under way, I can’t put myself in that position. I want you to know I’m not trying to leave you hanging out there to dry.” Libby says little in response. [McClellan, 2008, pp. 216-217]
Syndicated columnist Robert Novak, who publicly outed former ambassador Joseph Wilson’s wife Valerie Plame Wilson as a CIA officer in one of his columns three months earlier (see July 14, 2003), writes that he is now forced to revisit that column since “repercussions” from it “have reached the front pages of major newspapers and led off network news broadcasts.” Today’s column, he writes, is to clarify his actions and those of the Bush White House, which have been “distorted” in media reports. Novak says he “did not receive a planned leak” (see Late June 2003, July 8-10, 2003, and July 8, 2003). He asserts that “the CIA never warned me that the disclosure of Wilson’s wife working at the agency would endanger her or anybody else” (see Before July 14, 2003 and September 27, 2003). And, Plame Wilson’s identity “was not much of a secret” (see Before July 14, 2003).
Husband the Real Issue, Novak Claims - Novak attempts to turn the issue around and make Joseph Wilson and the Democrats the focus of the controversy: “Wilson, after telling me in July that he would say nothing about his wife, has made investigation of the leak his life’s work—aided by the relentless Sen. Charles Schumer of New York. These efforts cannot be separated from the massive political assault on President Bush.” Novak points out that Wilson, whom he falsely describes as a former “high-ranking official in President Bill Clinton’s National Security Council,” is now “a vocal opponent of President Bush’s policies in Iraq after contributing to Al Gore in the last election cycle and John Kerry in this one.” (Novak fails to note that Wilson gave campaign contributions to both Republicans and Democrats—see September 30, 2003). Why, Novak asks, was such a “partisan Democrat” given the assignment to investigate the Iraq-Niger uranium claims (see July 6, 2003)?
Again Asserts Wife Sent Wilson to Niger - Novak says that according to “a senior administration official,” Wilson was sent to Niger “by the CIA’s counterproliferation section at the suggestion of one of its employees, his wife. It was an offhand revelation from this official [later revealed as Deputy Secretary of State Richard Armitage—see Late June 2003 and July 8, 2003], who is no partisan gunslinger.” Novak called a second official, later confirmed as White House political adviser Karl Rove (see July 8, 2003), who said, “Oh, you know about it.” Novak calls reports that White House officials “failed to plant this story with six reporters and finally found me as a willing pawn is simply untrue.” He acknowledges being asked not to reveal Plame Wilson’s identity by the CIA official “designated to talk to me,” but denies being told that others might be harmed or intelligence networks might be damaged by the revelation. As for Plame Wilson’s identity being “no big secret,” he asserts, falsely, that Republican activist Clifford May knew of her identity before his column appeared, and, according to May, her CIA status was “common knowledge” (see July 12, 2004). Novak also notes that “Valerie Plame” is listed as Joseph Wilson’s wife in her husband’s “Who’s Who in America” entry, though he fails to note that the entry does not identify her as a CIA employee. He goes on to say that the CIA did not describe her as an “operative,” but a mere “employee” who is “covered”—working under the auspices of another agency. He writes, again falsely, that Plame Wilson “has been an analyst, not in covert operations” (see Fall 1992 - 1996 and April 2001 and After). Finally, Novak writes that the Justice Department investigation was not, in fact, requested by CIA Director George Tenet (see September 26, 2003). The request for an investigation was routine, he claims, one of around one such request a week. [Town Hall (.com), 10/1/2003]
Syndicated columnist Robert Novak, who has already outed Valerie Plame Wilson as a CIA agent (see July 14, 2003), now outs the CIA front firm that was her cover. In a column reporting that Plame Wilson and her husband Joseph Wilson made campaign donations of $1,000 each to Democratic presidential candidate Al Gore in 1999, Novak notes that Plame Wilson, under her married name of Valerie E. Wilson, “identified herself as an ‘analyst’ with ‘Brewster Jennings & Associates.’ No such firm is listed anywhere, but the late Brewster Jennings was president of Socony-Vacuum oil company a half-century ago. Any CIA employee working under ‘non-official cover’ always is listed with a real firm, but never an imaginary one. Sort of adds to the little mystery.” Novak fails to mention that Joseph Wilson also donated $1,000 to the campaign of George W. Bush. He also fails to note that he has indirectly admitted that he knew Plame Wilson was an undercover CIA agent. [Town Hall (.com), 10/4/2003; Washington Post, 10/4/2003] In 2005, Joseph Wilson will tell a reporter that Novak’s outing of Brewster Jennings indicates a “pattern of disclosure,” presumably indicating that Novak’s revealing of state secrets may rise to the level of criminal behavior. The leak of Valerie Plame Wilson’s identity as a CIA officer by conservative columnist Robert Novak (see July 14, 2003) has resulted in the exposure of a CIA front company, potentially causing widespread damage to overseas intelligence gathering. Yesterday, Novak revealed the name of the firm in another column (see October 2, 2003). The fictitious Boston firm, Brewster Jennings & Associates, appears in Federal Election Commission records on a 1999 form filled out by Plame Wilson when she donated $1,000 to the presidential campaign of Al Gore (D-TN). Once the Novak column was published, CIA officials admitted that it is a front. Brewster Jennings is listed as Plame Wilson’s employer on her 1999 tax forms, though she was working as an undercover CIA officer at the time. A former diplomat says that since Brewster Jennings and Plame Wilson have been exposed, every foreign intelligence service is running the names through their own databases to determine whether she ever visited their countries and what kinds of contacts she made there. “That’s why the agency is so sensitive about just publishing her name,” the former diplomat says. [Washington Post, 10/4/2003]
Plame's NOC Status, 'Legend' - As one of a very small, select number of “nonofficial cover” officers, Plame Wilson would have enjoyed little or no government protection had her cover been blown while she was overseas. Training officers such as her cost millions of dollars and require elaborate constructions of fictional background, called “legends,” including the creation of CIA front companies such as Brewster Jennings. The amount of damage caused by the outing of Plame Wilson and Brewster Jennings is incalculable. Former CIA counterterrorism chief Vincent Cannistraro says many other CIA agents and foreign assets are now endangered, and future attempts to convince foreign citizens to share information with US intelligence agencies will be hampered. Former CIA and State Department official Larry Johnson, who trained with Plame Wilson in 1985, says that when the damage is fully assessed, “at the end of the day, [the harm] will be huge and some people potentially may have lost their lives.” Johnson describes himself as “furious, absolutely furious” at the breach. “We feel like the peasants with torches and pitchforks,” he says. “The robber barons aren’t going to be allowed to get away with this.” Former CIA officer Jim Marcinkowski, who also trained with Plame Wilson, agrees: “This is not just another leak. This is an unprecedented exposing of an agent’s identity.” While the CIA continues to keep details of Plame Wilson’s career secret, it is known that she was attached to a US embassy in Europe in 1990 and 1991 (more information on her overseas postings will later be revealed—see Fall 1985, Fall 1989, Fall 1992 - 1996, and April 2001 and After). It is known that when Novak blew her cover, she was a senior case officer for the CIA’s counterproliferation division, working with intelligence about hostile countries and WMD. “All the people who had innocent lunches with her overseas or went shopping or played tennis with her, I’m sure they are having heart attacks right now,” says one former colleague who was also in covert operations. “I would be in hiding now if I were them.” [Washington Post, 10/8/2003; Knight Ridder, 10/11/2003]
Brewster Jennings Just One of Plame Wilson's Cover Firms - Former intelligence officials confirm that Brewster Jennings was just one of several cover affiliations that Plame Wilson used when she was operating overseas. “All it was was a telephone and a post office box,” says one former intelligence officer. “When she was abroad she had a more viable cover.” [Boston Globe, 10/10/2003] Cannistraro will later add that when Plame Wilson was operating undercover outside the US, she would have had a real job with a more legitimate company. The Boston company “is not an indicator of what she did overseas.” Now, those firms are themselves in jeopardy of exposure for working with US intelligence. [Wilson, 2007, pp. 343-344] In 2007, former CIA and National Security Council official Bruce Riedel will say: “I have looked at the part of her CV that is in the open domain. The agency spent an awful lot of effort building a really good cover for this person. A lot of effort. People who say this was not a covert operative don’t understand what they’re saying. This was intended to be a nonofficial cover person who would have the credentials to be a very serious operative. The damage done to the mission of the organization by exposing her, and how cover is built, is pretty serious.” [Wilson, 2007, pp. 343]

After being ordered to assure the press that Lewis “Scooter” Libby knew nothing of the Plame Wilson leak (see October 4, 2003), White House press secretary Scott McClellan agrees to follow that order if Libby himself will give him that same assurance. McClellan calls Libby and asks, “Were you involved in the leak in any way?” Libby replies, “No, absolutely not.” Together, they decide what reporters McClellan should call, and McClellan begins spreading the word among a wide array of national media correspondents. [McClellan, 2008, pp. 218-220] (Later research by author and blogger Marcy Wheeler indicates the reporters McClellan contacts are most likely the Associated Press’s Scott Lindlaw, Michael Isikoff or Evan Thomas of Newsweek, an unnamed reporter for the New York Times, and the Washington Post’s Mike Allen.) [Marcy Wheeler, 6/10/2008] The line is, as agreed upon, Libby “neither leaked the classified information, nor would he condone it.” Shortly afterwards, McClellan decides on his own to make the same assurances about National Security Council staffer Elliott Abrams, who has angrily denied rumors of his own involvement (see October 5, 2003). “I was becoming increasingly frustrated,” McClellan will write, “as this was exactly what I didn’t want to happen. I was putting myself in the middle of the investigation by publicly vouching for people, against my own wishes and against the sound advice of White House counsel.… In hindsight, the president should have overruled his advisers and demanded that an internal investigation be conducted to determine whether there might have been any White House involvement. He also should have ordered the public release of as much information as possible as soon as it was known, so that the scandal would not take on a life of its own.” McClellan will theorize that Bush “chose not to do so, perhaps feeling that keeping clear of the story would insulate him and protect him from potential political damage. Instead, it gave the story broader and longer life, only helping to reinforce the permanent state of suspicion and partisan warfare he had pledged to move beyond.” [McClellan, 2008, pp. 218-220]
At his home, White House press secretary Scott McClellan receives a call from White House chief of staff Andrew Card. Card makes a request that shocks McClellan: “The president and vice president spoke this morning. They want you to give the press the same assurance for Scooter [Lewis Libby, the vice president’s chief of staff] that you gave for [White House deputy chief of staff] Karl [Rove]” (see September 29, 2003). According to McClellan’s 2008 book What Happened, he acquiesces, “not really indicating my instinctive disinclination to do what he was directing me to do.” McClellan doesn’t want to begin absolving one official after another to the press. He has already refused to absolve Libby for the press once (see October 1, 2003), and knows “if other names started to surface… the press would be curious why I’d asked Scooter about his involvement, and why the White House wasn’t asking every staff member the same question.” However, he will write: “this was an order coming from on high. As a result, I was about to cross the line I’d drawn publicly once the investigation had gotten underway earlier in the week.” McClellan will write that he is sure President Bush had no knowledge of Libby, Rove, or anyone else being involved in leaking Plame Wilson’s identity. “I wish I could say the same about the vice president,” he will add. “I simply don’t know for sure.” [McClellan, 2008, pp. 217-218] Card makes his request shortly after Vice President Cheney writes a memo demanding Libby’s public exoneration (see October 4, 2003).
Through White House spokesmen, two senior Bush officials deny being involved in the Valerie Plame Wilson identity leak (see July 14, 2003 and July 17, 2003). Neither Lewis “Scooter” Libby, chief of staff for Vice President Dick Cheney, nor Elliott Abrams, the director of Middle East affairs for the National Security Council, were involved in the leak, according to spokesmen; the same claim has been made for White House deputy chief of staff Karl Rove. According to press secretary Scott McClellan, Libby “neither leaked the classified information, nor would he condone it.” The disclaimers are in response to reporters’ questions. [New York Times, 10/5/2003] In 2007, the prosecution in the Libby perjury trial (see January 16-23, 2007) will enter into evidence a page of undated notes taken by Libby around this time. The notes are talking points for McClellan, and indicate that McClellan should use lines such as “I’ve talked to Libby. I’ve said it was ridiculous about Karl and it is ridiculous about Libby. Libby was not the source of the Novak story. And he did not leak classified information.” Libby’s notes also advise McClellan to say something like, “Not going to protect one staffer & sacrifice the guy the Pres that was asked to stick his neck in the meat grinder because of the incompetence of others.” Cheney has crossed out the words “the Pres,” obviously not wanting McClellan to reference President Bush (see October 4, 2003). [Source: University of Maryland]Communications professor Shawn Parry-Giles says that she hears echoes of the rhetoric of former Vice President Spiro Agnew in Defense Secretary Donald Rumsfeld’s speeches about Iraq (see 1969-1971). Parry-Giles says: “Spiro T. Agnew’s resignation is often lost in the turmoil surrounding the painful events of Watergate (see October 10, 1973). Yet his campaign against the US news media during the Vietnam War still resonates, especially among those who covered the war. In a recent press conference… Rumsfeld emphasized all the good that has come from the US efforts in that war torn country. In listening to his press conference, I heard echoes of… Agnew’s famous line: ‘In the United States today, we have more than our share of the nattering nabobs of negativism.’ If the war in Iraq continues on its current trajectory, we might expect the spirit of Agnew to rise once again, as the Bush administration reminds the US news media and the [D]emocratic presidential candidates that in times of international conflict, we are to remain unified.” [University of Maryland Newsdesk, 10/6/2003]
The American Civil Liberties Union (ACLU), in partnership with the Center for Constitutional Rights, Physicians for Human Rights, Veterans for Common Sense, and Veterans for Peace, file a Freedom of Information Act (FOIA) request for records concerning the treatment of prisoners and detainees in US custody abroad, most specifically Iraq and Afghanistan. The request is the first spark in a firestorm of legal controversies, FOIA requests, government denials, and lawsuits, as the ACLU and its partners continue to attempt to squeeze documentation out of an uncooperative administration. Although the government will continue to withhold key records, ongoing litigation results in the eventual release of over 100,000 documents, which will be used by ACLU lawyers Jameel Jaffer and Amrit Singh to compile the book Administration of Torture (see October 22, 2007), which will show that detainees have been (and will be) systematically tortured and abused under the orders of senior government officials. It is co-written by Iraqi lawyer Mohammed Odeh al-Rehaief, who provided US forces with information necessary for the rescue of Lynch (see June 17, 2003). Al-Rehaief was rewarded for his contributions with political asylum in the US, a job with a Republican-owned lobbying firm, and a $300,000 book contract (see April 10, 2003 and After). The book was promoted by former US Information Agency official Lauri Fitz-Pegado, who in 1990 worked for public relations firm Hill & Knowlton. While at that firm, Fitz-Pegado helped run the propaganda campaign that alleged Iraqi forces had broken into a Kuwaiti infirmary, thrown Kuwaiti babies to the floor, and stolen their incubators. The story was catapulted into the headlines by the gripping testimony of a 15-year old girl, “Nayirah,” who testified before Congress that she had witnessed the atrocities (see October 10, 1990). The girl was actually the daughter of the Kuwaiti ambassador to the US and had been coached on what to say by Fitz-Pegado. Like Naiyrah’s, al-Rehaief’s story is riddled with apparent falsehoods, including the now well-known story of Lynch being slapped by a black-clad Iraqi Fedayeen, a tale disputed by the doctors and nurses at the hospital in which Lynch was receiving care. Executives of the Livingston Group, the lobbying firm which now employs al-Rehaief, say that his life is in danger from “terrorists,” though they give no details of the alleged threats; interestingly, the firm canceled an appearance by al-Rehaief at the National Press Club shortly before the book’s release, thus denying reporters a chance to question al-Rehaief about his version of events. In the book, al-Rehaief writes, “I cannot say how I had pictured this American POW but I never imagined her as quite so small or quite so young.” When he saw her being slapped, he writes: “In that moment I felt compelled to help that person in the hospital bed. I had no idea of what I could do, but I knew that I had to do something.” Independent reporter Andrew Buncombe calls the book an example of “the murky world where myth, reality and disinformation merge…” [Independent, 10/19/2003; United Press International, 10/23/2003; Public Relations Watch, 6/3/2007]
Amnesty International publishes a report stating that it believes that “the totality of conditions” in which “most” of the detainees at Guantanamo are being held may itself amount to cruel, inhuman, or degrading treatment. Amnesty notes that the Committee against Torture, established to oversee implementation of the Convention against Torture (see October 21, 1994), “has expressly held that restraining detainees in very painful positions, hooding, threats, and prolonged sleep deprivation are methods of interrogation which violate the prohibition on torture and cruel, inhuman or degrading treatment.” [Amnesty International, 10/20/2003]

[Source: Al-Jazeera / CNN]Army Specialist Shoshana Johnson, captured in the same Iraqi assault that ended in the captivity and eventual rescue of Private Jessica Lynch (see June 17, 2003), has faced a very different ordeal than her more famous comrade. Johnson was held captive for 22 days before being released. During her captivity, she was shot in both legs. She still suffers from severe physical and emotional trauma. She has not spoken out while Lynch became the focus of so much media attention, but she now feels she must: the Army has informed her that she will receive only a 30 percent disability benefit for her injuries. Lynch will receive an 80 percent disability benefit. Johnson is African American; Lynch is Caucasian. The difference amounts to between $600-$700 per month, a significant amount for Johnson, who is raising a three-year-old daughter. Johnson’s family has enlisted the help of civil rights activist Jesse Jackson to help make their case in the national press. Jackson says the discrepancy implies that a racial double standard is at work in the two women’s cases. “Here’s a case of two women, same [unit], same war; everything about their service commitment and their risk is equal,” Jackson says. “Yet there’s an enormous contrast between how the military has handled these two cases.” Philadelphia radio host Mary Mason says more bluntly: “Shoshana is getting the shaft, and people are outraged about it. It’s ridiculous, and complete racism.” Some have speculated that the difference in race and appearance—Lynch, a winsome, tiny blonde, is acknowledged to be quite photogenic, while Johnson is darker and heavier-featured—may have played a role in the selection of Lynch over Johnson to gain such heavy media coverage. Johnson’s father Claude, an Army veteran, says neither Shoshana nor the family begrudge Lynch her disability. They just believe that the benefits should be more equal. Lynch says she and Johnson are friends, and she hopes Johnson receives every benefit due her. The Army denies any bias, and says its decision on benefits is made according to a soldier’s injuries. Democratic political strategist Donna Brazile, an African American, says she won’t watch the NBC movie about Lynch’s ordeal (see November 10, 2003). “Jessica’s story is a compelling story, but so is Shoshana’s,” she says. “My reason for not tuning in is simple: I am tired of the double standard.” [Black Entertainment Television, 10/24/2003; Boston Globe, 11/9/2003] Johnson’s benefits will later be revised upwards (see March 18, 2008).

She calls anonymously to discuss her recent visit to the Walter Reed Army Medical Center, where she visited with soldiers wounded in Iraq. She praises the courage and resilience of the soldiers, many of whom have suffered horrific wounds. After she admits to being an entertainer who has worked with the USO, C-SPAN host Peter Slen realizes who she is, and asks, “Is this Cher?” She replies, “Yeah,” and continues to discuss the troops and their “unbelievable courage.” Shortly thereafter, she says: “I wonder why [Dick] Cheney, [Paul] Wolfowitz, [Paul] Bremer, the president—why aren’t they taking pictures with all these guys?… Talking about the dead and wounded, that’s two different things. But these wounded are so devastatingly wounded.… It’s unbelievable. You know, if you’re going to send these people to war, then don’t hide them.… Have some news coverage where people are sitting and talking to these guys and seeing how they are and seeing their spirit. It’s just—I think it’s a crime.” [Village Voice, 11/5/2003; Carter, 2004, pp. 65-66] Shortly after the Walter Reed visit, Cher will become heavily involved in working with wounded veterans through organizations such as Operation Helmet and the Intrepid Fund. She will say of her activism: “I don’t have to be for this war to support the troops because these men and women do what they think is right. They do what they’re told to do. They do it with a really good heart. They do the best they can. They don’t ask for anything.… I can’t speak for everyone, but everyone seems to be against the war but not realizing that that’s not good enough. You’ve got to do something besides just be against it. You’ve got to do some helping as well.” [Stars and Stripes, 7/16/2006]
Former ambassador Joseph Wilson sits down with Jeff Gannon of Talon News to discuss the outing of his wife, Valerie Plame Wilson, as a CIA agent (see July 14, 2003), his trip to Niger that helped debunk the claim that Iraq tried to buy uranium from that country (see February 21, 2002-March 4, 2002 and July 6, 2003), and his concerns over the Iraq war. Wilson is unaware that Gannon is in reality James Guckert, a gay prostitute who moonlights as a fake journalist for the right-wing Talon News (see January 26, 2005 and January 28, 2005). Little of what Gannon/Guckert elicits is new information.
Access to Classified Information? - However, early in the interview, Gannon/Guckert refers to a classified memo when he says, “An internal government memo prepared by US intelligence personnel details a meeting in early 2002 where your wife, a member of the agency for clandestine service working on Iraqi weapons issues, suggested that you could be sent to investigate the reports.” The FBI will investigate Gannon/Guckert’s knowledge of the memo, but he will deny ever having seen it. It is not clear from whom he learned of the memo [Talon News, 10/28/2003; Wilson, 2007, pp. 216] , though he will insist that he received the information from “confidential sources.” [Antiwar (.com), 2/18/2005]
America Did Not Debate Redrawing the Middle East as a Rationale for War - Wilson notes that he considered “the invasion, conquest, and occupation of Iraq for the purpose of disarming Saddam [Hussein] struck me as the highest risk, lowest reward option.… [W]e ought to understand that sending our men and women to kill and to die for our country is the most solemn decision a government has to make and we damn well ought to have that debate before we get them into harm’s way instead of after.” He explains why the idea that his wife selected him for the Niger mission is incorrect. When Gannon/Guckert attempts to pin him down by citing the initial meeting in which Plame Wilson suggested Wilson for the mission (see February 13, 2002), Wilson notes, “[T]hat fact that my wife knows that I know a lot about the uranium business and that I know a lot about Niger and that she happens to be involved in weapons of mass destruction, it should come as no surprise to anyone that we know of each others activities.” Wilson says that the aims of the administration’s neoconservatives—to redraw “the political map of the Middle East,” is something that has not been debated by the nation. The US did not debate the war with Iraq “on the grounds of redrawing the map of the Middle East,” he notes.
Wilson Did Not Violate CIA Secrecy in Revealing Niger Mission - Gannon/Guckert asks if Wilson violated CIA secrecy in going public with the results of his Niger mission, as some on the right have asserted. Wilson reminds Gannon that his was not a clandestine trip, “not a CIA mission,” but an aboveboard fact-finding journey. Those circumstances were well understood by the CIA before he left for Niger.
Implications of French Complicity in Niger Allegations Debunked - Gannon/Guckert tries to insinuate that the French may have had something to do with keeping the alleged uranium sales secret, and Wilson quickly shoots that line of inquiry down, saying, “The fact that you don’t like the French or that the French seem to have favored a different approach on this is far different from the French violating UN Security Council resolutions of which they are signatories, and clandestinely transferring 500 tons of uranium to a rogue country like Iraq is a real reach.” He then describes just how impossible it would have been for the French to have facilitated such a secret uranium transfer even had it wished.
Refuses to Accuse Rove Directly - Wilson refuses to flatly name White House political strategist Karl Rove as the person behind the leaks of his wife’s clandestine identity, though he notes that Rove indeed labeled his wife “fair game” to the press (see July 21, 2003) and that Rove was in a perfect position to have orchestrated the leak. When Gannon/Guckert tells Wilson that conservative columnist Robert Novak, who first published Plame Wilson’s name and occupation, denies that the White House gave him the information on her identity, Wilson retorts, “Novak has changed his story so much that it’s hard for me to understand what he is talking about” (see September 29, 2003).
When a Leak Is Not a Leak - Gannon/Guckert brings up the allegation from New York Times columnist Nicholas Kristof that Plame Wilson was revealed as an undercover agent by Russian spy Aldrich Ames in 1994. Because Ames may have revealed Plame Wilson’s identity to the Russians, Gannon/Guckert asks, isn’t it possible that she was no longer an undercover agent? Wilson refuses to validate the Ames speculation, and finally says that the CIA would not be treating this so seriously if it were as frivolous an issue as Gannon/Guckert suggests. “[R]emember this is not a crime that has been committed against my wife or against me,” he says. “If there was a crime, it was committed against our country. The CIA has referred the matter to the Justice Department for further investigation, I don’t believe that’s a frivolous referral.” [Talon News, 10/28/2003]
At the Asian-Pacific Economic Summit in Bangkok, Thailand, President Bush lauds Australian Prime Minister John Howard for resisting his country’s parliament and sending troops to Iraq in support of the US. Bush says that the Iraq invasion will transform the Middle East into a region of democracy. “Iraq will change the Middle East,” he says. “Iran will change” because of what the US is doing in Iraq. “I believe Iraq is the place” that will make democracy flourish in the region. “It will evolve into a democratic, free” country like Turkey or Bahrain is “moving to.… I believe it is going to happen.” [McClellan, 2008, pp. 195-196]
The Office of Legal Counsel (OLC)‘s Nicholas Quinn Rosenkranz sends a classified memo to his boss, OLC chief Jack Goldsmith. The contents of the memo will remain secret, but the American Civil Liberties Union (ACLU) will later learn that the memo concerns the Geneva Conventions. The commander of US forces in Iraq, General Ricardo Sanchez, says the week of unprecedented violence in Iraq is nothing more than “a strategically and operationally insignificant surge of attacks.” Less than 24 hours later, the US will suffer its biggest single loss of troops since the invasion began (see November 2, 2003). [Source: Associated Press]Iraqi insurgents shoot down a US Army Chinook helicopter near Fallujah, killing 16 US soldiers and wounding 21. (Initial reports put the figures at 13 dead and 20 wounded. Subsequent deaths of soldiers mortally wounded in the attack push the death toll to 16.) [CBS News, 11/3/2003; American Forces Press Service, 11/3/2003] The shootdown is the deadliest single attack on American forces since the invasion began. Defense Secretary Donald Rumsfeld calls the incident a national tragedy for Americans. “Clearly it is a tragic day,” Rumsfeld says. “In a long hard war, we are going to have tragic days. But they are necessary. They are part of a war that is difficult and complicated.” The Chinook, transporting over 50 troops from Habbaniyah Air Base to the Baghdad airport, where they were to depart Iraq for leave time, is shot down by insurgents wielding a Soviet-made SA-7 surface-to-air missile (SAM). (US officials have long warned that hundreds of SAMs remain unaccounted for, and many are undoubtedly in the hands of insurgents.) Another Chinook, accompanying the downed craft, fires a flare to divert a second missile. Within minutes, US Black Hawk helicopters arrive in large numbers. The dead and wounded are rushed to a nearby hospital. At the same time, soldiers secure the site, in the process ordering journalists on the scene to turn over any film they may have shot of the crash and forcing them to leave. Villagers and nearby farmers celebrate the attack by waving pieces of the smoking wreckage. The attack caps an eight-day surge in violence that has left 27 US soldiers dead. Fallujah is a Sunni stronghold and the center of intense resistance to the US occupation. A slogan painted on a wall in the town reads, “Fallujah will always be a cemetery for the Americans.” [CBS News, 11/3/2003; CounterPunch, 11/3/2003]

An editorial in Britain’s Guardian notes that the downing of a Chinook transport helicopter near Fallujah (see November 2, 2003) is likely to have “a disproportionate psychological impact on US military operations in Iraq and on US public opinion.” The editorial observes that “[t]he perception, in America itself and abroad, is that the security situation in Iraq is deteriorating, rather than improving as President George Bush claims. US-led coalition forces are now being subjected to an average of over 30 attacks daily. Hardly a day passes without news of one or more US fatalities. Far from being accepted as routine, this toll appears to be convincing more and more ordinary Americans that Mr Bush and his officials are not in control of a situation that they, uniquely, created.” Violence in Iraq is escalating on a daily, and deadly, basis, with “soft targets” such as Red Cross and other civilian relief organizations being targeted along with military personnel. Whether foreign terror organizations such as al-Qaeda or native insurgents are responsible for the wave of violence, “[t]he bottom line is relentless violence and mayhem and a US leadership that appears powerless to stop it. This perception that Mr Bush’s Iraq campaign lacks direction and is one over which he is losing control is exemplified, even symbolized, by the dramatic loss of the Chinook. This sense of rudderlessness may prove to be even more damaging to him in the long run than the many controversies that still surround his decision to go to war in the first place.” [Guardian, 11/3/2003]

Buckley writes of the recent shootdown of an American Chinook helicopter near Fallujah (see November 2, 2003). Buckley writes that although the losses are undoubtedly devastating to the families of the slain soldiers, “one does endure such losses. Consider Jackie Kennedy [widow of the assassinated President Kennedy]. She survived it; so will the mothers, fathers and spouses of the victims of the Fallujah missile. What is one shade less than absolutely predictable is whether our foreign policy will survive that anti-helicopter missile.” Buckley compares the Fallujah attacks to the Tet offensive in Vietnam in 1968, a military offensive mounted by the North Vietnamese that was a military failure but a public relations success that pushed the US irrevocably towards what Buckley calls “the retreat of 1972 and the surrender of 1975.” The US cannot let such attacks drive them precipitously from Iraq, Buckley writes. “[T]he idea is that US aircraft should be safe wherever they fly, and we are in Iraq because of its infestation.” Iraq still reels from the effects of what Buckley calls “a Stalinist dictatorship,” and is still plagued by insurgents and rebels who want to reintroduce some form of post-Hussein dictatorship. Besides, Buckley writes, one must consider the losses in Iraq in perspective. “Our casualties since the beginning of the war have reached 400. Last year, 16,000 Americans were murdered within the boundaries of the United States. That same year, 43,000 Americans were killed in automobile accidents.” He concludes: “If all surveillance of the Iraqi theater were to end today, and begin again when Iraq is a settled state, governed by its own people making their way toward freedom, it is inconceivable that the losses sustained during the hiatus would appear to Americans as disproportionate to the ends achieved. What’s needed is to nurture that moral perspective that the idiot children of Fallujah were deprived of.” [Universal Press Syndicate, 11/4/2003]
An Afghani civilian later identified as Abdul Wahid dies from what his autopsy report calls “multiple blunt force injuries to head, torso, and extremities.” Wahid is being held by US forces at a forward operating base in Helmand province. [American Civil Liberties Union, 10/24/2005]
Congress passes a law that states US officials in Iraq cannot prevent an inspector general for the Coalition Provisional Authority from carrying out any investigation. The inspector general will inform Congress if officials refuse to cooperate with his inquiries. President Bush issues a signing statement directly contradicting the law. According to Bush’s statement, the inspector general “shall refrain” from investigating anything involving sensitive plans, intelligence, national security, or anything already being investigated by the Pentagon. The inspector cannot tell Congress anything if the president decides that disclosing the information would impair foreign relations, national security, or executive branch operations. [Boston Globe, 4/30/2006]
Time magazine does a cover story on the recovering Private Jessica Lynch, who is the subject of a biography (see November 11, 2003) and a television movie (see November 10, 2003). The article profiles Lynch as she recovers from her wounds at her home in West Virginia. She says she had no idea that within hours of her rescue from an Iraqi hospital (see June 17, 2003), she had become an instant celebrity (see April 3, 2003). “I didn’t think that anyone out there even knew I existed, let alone write me a letter,” she says. “I was asking my mom, ‘Did I make the hometown Journal?’ She was like, ‘Yeah, you made it, plus all these world papers.’” Her father Greg recalls that she and the family were excited when Defense Secretary Donald Rumsfeld came to their home to visit. “That was rewarding,” he says. “Not every day that you meet the big boys.” President Bush has not called the Lynch home, but, according to her father, she does not expect him to call. “He’s got a job to do,” her father says. Her physical recovery is a slow, unsteady process, but she is improving, her parents and physical therapist say. [Time, 11/9/2003]
The International Atomic Energy Agency (IAEA) reports that it has found “no evidence” Iran is trying to make nuclear weapons. But it says that because Iran has been secretive in the past it is not ruling out the possibility. The report, authored by IAEA chief Mohamed ElBaradei, says, “To date there is no evidence that the previous undeclared nuclear material and activities… were related to a nuclear weapons program.” [CNN, 11/10/2003]

The film is based on the dubious account by Iraqi lawyer Mohammed Odeh al-Rehaief as published in his book Because Every Life is Precious, and actually makes al-Rehaief, not Lynch, the central figure. Lynch and her family refused to take part in the movie’s production; Lynch even refused to meet with al-Rehaief when he journeyed to her hometown in West Virginia. Days before its airing, Entertainment Weekly critic Ken Tucker, after previewing it, lambasted it as “odious,” slammed its “assiduously bland storytelling,” and said that it “represents everything that’s wrong with this genre,” a subdivision of TV docudramas that he calls the “so-called women-in-jeopardy telefilm.” The New York Times’ Alessandra Stanley calls it a “shameless attempt [by NBC] to capitalize on [a] real-life horror stor[y].” A later Times review will note, “An inordinate amount of poetic license is taken with the events surrounding Jessica’s rescue, with a plethora of ridiculous coincidences and serial-like thrills and chills thrown in to pep up the story.” [New York Times, 11/7/2003; Baltimore Sun, 11/11/2003; New York Times, 2008] (NBC airs a disclaimer at the beginning of the movie: “This motion picture is based on a true story. However, some names have been changed and some characters, scenes and events in whole or part have been created for dramatic purpose.”) [Salon, 11/13/2003] In a review for the Deseret News, Scott Pierce writes, “If I thought NBC executives were capable of feeling shame, I’d suggest that they should be ashamed of themselves for foisting Saving Jessica Lynch off on viewers.” He calls the movie “a simple case of a network investing itself and its money in a project designed to grab ratings without pausing to find out what the real story was. And then not really worrying too much about getting its facts straight.… Never mind that the original story Americans were told about the rescue turned out to be largely bogus. Never mind that independent news organizations have called into question al-Rehaief’s version of events. This was ‘created for dramatic purposes.‘… [W]hat makes the telefilm nothing short of reprehensible is that, disclaimer or not, it presents fiction as fact and exploits the facts for ratings. I can’t help but think of how the families of the soldiers who died must feel about this.” [Deseret News, 11/8/2003]
Cover of I Am a Soldier, Too. [Source: Entertainment Weekly]Rick Bragg’s biography of Jessica Lynch (see June 17, 2003) is released under the title I Am a Soldier, Too (see September 2, 2003). Entertainment Weekly reviewer Tina Jordan says the book is straightforward, and shows Lynch as a humble young woman refusing to take credit for things she did not do: “I didn’t kill nobody,” Lynch says. Her memory of the hours after her injuries in the initial ambush are gone, and her story of her nine days under the care of Iraqi doctors parallels the story as told by other media sources after the initial propaganda blitz from the US military and media outlets such as the Washington Post (see April 1, 2003) had run its course. (The initial propaganda onslaught had an effect: a Marine interviewed for the book recalls: “I took it right to heart. I have a sister. She’s 19.… I thought of the people who would do that. I wanted to kill them. I killed 34 of them.”
Three-Part Structure - Bragg divides the book into three parts: the first a retelling of Lynch’s life before joining the Army, as another young woman in an impoverished West Virginia hamlet who, like her brother and so many other young people of the area, joined the military in hopes to build a future for herself. The second part of the book focuses on the March 23 ambush and capture (see March 23, 2003), and her nine days as a patient in an Iraqi hospital (see May 4, 2003). The third and last part of the book chronicles Lynch’s attempt to set her story straight. She never attempted to claim any undue credit for herself, consistently refusing to embrace the myth of her “heroism” in which the military and the media attempted to cloak her (see April 3, 2003).
Allegation of Rape - Jordan writes that “Bragg manages to suppress his penchant for overblown prose to give the straight story on Lynch’s remarkable ordeal.” New York Times reviewer David Lipsky is less forgiving, noting numerous infelicitously written passages and concluding that the book suffered from being written under a tight deadline. But amidst the sober retelling of facts, Bragg heads off in a controversial direction: alleging a sexual assault that Lynch does not recall suffering. [Baltimore Sun, 11/11/2003; Entertainment Weekly, 11/19/2003; New York Times, 12/14/2003] Lynch herself says she read the book but skipped the parts that were too hard for her to relive, the parts, she says, that made her parents cry. As for the allegation that Lynch was raped, Bragg says it was her parents that wanted that included in the book: “because if we didn’t put it in, the story wouldn’t be compete. It would be a lie.” [Time, 11/9/2003] But a Philadelphia Inquirer book reviewer notes angrily: “[The] revelation that she was sexually assaulted during those lost three hours, timed specifically to promote this book and her appearances, is repugnant, virtually unparalleled in the rancid history of publicity. It’s rape as a marketing tool.” [Salon, 11/13/2003]
No Extra Copies - One Connecticut bookstore owner is asked if her store will order extra copies of Lynch’s biography; she guffaws: “You must be kidding! Who cares? This story has been told to the nth degree.” [Salon, 11/13/2003]

[Source: ABC News / CNN]ABC airs an interview with Army Private Jessica Lynch (see June 17, 2003); the press reports elements from the interview four days in advance, from ABC press releases. In the interview, conducted by Diane Sawyer, Lynch says that the US military overdramatized the story of her rescue from an Iraqi hospital in Nasiriyah, a charge denied by US military officials, who blame the news media for reporting the story with incomplete information. Asked if the military exaggerated the danger of her rescue by US Special Forces commandos, Lynch replies, “Yeah, I don’t think it happened quite like that.” However, she says, it would have been foolish for her rescuers to go in less prepared. Any such unit “in that kind of situation would obviously go in with force, not knowing who was on the other side of the door.” The way the US military publicized her rescue (see April 1, 2003) upsets Lynch. “It does [bother me] that they used me as a way to symbolize all this stuff,” she says. “It’s wrong. I don’t know why they filmed it, or why they say the things they [say], you know.… All I know was that I was in that hospital hurting.… I needed help. I wanted out of there. It didn’t matter to me if they would have come in shirts and blank guns; it wouldn’t have mattered to me. I wanted out of there.” She has nothing but praise for her rescuers: “I’m so thankful that they did what they did. They risked their lives.”
Disputes Rape, Abuse Allegations in Biography - An upcoming book about her captivity (see September 2, 2003) alleges that she was raped by her Iraqi captors, a charge Lynch says she cannot confirm. The charge, placed in the book by author Rick Bragg, is based on what Bragg calls a medical report that shows Lynch was sexually assaulted. Lynch has no memory of any such assault, and says “even just the thinking about that, that’s too painful.” From what she remembers, she was well treated during her stay in the Iraqi hospital. One of the Iraqi doctors who treated her, orthopedic surgeon Dr. Mahdi Khafaji, says he found no evidence of any such sexual assault. She also says that the story of her being slapped by an Iraqi paramilitary officer, as retold in a recent movie of her ordeal (see November 10, 2003), is untrue. “From the time I woke up in that hospital, no one beat me, no one slapped me, no one, nothing,” she says.
Feared Permanent Paralysis - Lynch recalls that while lying in the Iraqi hospital, she “seriously thought I was going to be paralyzed for the rest of my life. I’ve never felt that much pain in my whole entire life. It was, you know, from my foot to my other foot to my legs to my arms to my back, my head.” She does not consider herself a hero, she says: “I was just there in that spot, you know, the wrong place, the wrong time.”
Refuses to Take Credit for Fighting - Lynch confirms that when she and her fellow soldiers were attacked, she did not fire a single shot. Her weapon jammed when she tried to fire on her assailants. “I did not shoot, not a round, nothing,” she says. “I went down praying to my knees. And that’s the last I remember.” She says it hurt her to learn that initial news accounts portrayed her as emptying her weapon into her assailants, and finally falling due to multiple gunshot and knife wounds. Her injuries were all due to the crash of her vehicle. “It hurt in a way that people would make up stories that they had no truth about,” she says. “Only I would have been able to know that, because the other four people on my vehicle aren’t here to tell that story. So I would have been the only one able to say… I went down shooting. But I didn’t.” Lynch believes one of her fellow soldiers, Private Lori Piestewa, may have been the one who went down fighting. “That may have been her, but it wasn’t me, and I’m not taking credit for it,” Lynch says. Piestewa, Lynch’s best friend in the unit, was mortally wounded during the gunfight.
Wants to Teach Kindergarten - When she recovers, she says, she wants to teach kindergarten children. But she has to complete her physical therapy and fully recover from her injuries. She still has no feeling in her left foot, walks with crutches, and suffers from chronic kidney and bowel problems due to the injury to her spine. “I just want to keep adding, you know, just steps every day, just so eventually I can throw away the crutches and… just start walking on my own,” she says. “That’s my goal. 'Tough Interview' - Salon’s Eric Boehlert writes admiringly that “[t]he petite, tight-lipped Lynch is one tough interview.” She weathers Sawyer’s interview well, never losing her composure even after Sawyer, whom Boehlert says is notorious for “elicit[ing] on-camera tears,” surprised her with a photograph of the Iraqi hospital room Lynch had been held in. Boehlert writes: “The camera zoomed in on Lynch for a reaction. Yes, she calmly replied, that was the room she stayed in.” [Salon, 11/13/2003]
John Bolton, speaking at a dinner for the right-wing publication American Spectator, calls the conclusions of a forthcoming IAEA report (see November 10, 2003) on Iran’s nuclear activities “impossible to believe.” The widely leaked report says inspectors have found no evidence that Tehran is developing nuclear weapons. Bolton insists that Iran’s “massive and covert… effort to acquire sensitive nuclear capabilities make sense only as part of a nuclear weapons program.” [Bolton, 11/12/2003] Responding to Bolton’s remarks, IAEA’s Director General Mohamed ElBaradei tells Time magazine, “We are not in the business of judging intentions. What we look for are facts and proof, and so far we have no proof of a nuclear-weapons program. The jury is still out.” [Time (Europe), 11/24/2003]
National Public Radio (NPR) host Mike Pesca interviews New York media critic Michael Wolff regarding the storm of media hype and controversy surrounding the story of Private Jessica Lynch, particularly the recent television movie (see November 10, 2003) and biography (see November 11, 2003). Pesca notes: “[H]ere’s our sources on the Jessica Lynch story: an Iraqi doctor, Lynch herself, who has no memory of the ordeal, unnamed Pentagon sources, a TV movie of the week, and Rick Bragg, who left the New York Times for journalistic malfeasance. It’s like a multimedia Rashomon” (referring to the iconic Japanese film that retells a murder from multiple viewpoints, with no one version being completely factual). Wolff says there is reason to doubt virtually all of those sources: “[T]here is at this point reason to distrust and doubt everybody, because the heroine of this story also disputes everything that’s been said.” Wolff calls the story “a symbol of the Iraq war, [and] the Iraq war may be the symbol of the current media age.… [F]rom the very first moment it was clear that this story was going to be retailed essentially for political purposes, and it hasn’t moved off of that, although it has moved now into commercial purposes. We’ve gone from the Pentagon propaganda machine into the multimedia cross-platform propaganda machine.… I mean, everybody knows that this is not a real story. Nevertheless, we’re selling it all over the place.… I mean, the person right at the center of this story disputes every characterization of herself and of the events that took place. Nonetheless, we roll on. She gets her book deals. It’s as though there’s a parallel reality going here. Yeah, we know that the truth is over there, and that’s different from the stories that were being told, but we enjoy the stories that are being told so let’s forget about the truth.” Wolff is careful not to blame Lynch herself for the media frenzy surrounding her story: As a matter of fact, not only does she seem not to deserve the blame here, but every time she speaks, she says, ‘Oh, no, it didn’t happen that way.’ And no one seems to care.” [National Public Radio, 11/13/2003]
The Army issues “stop-loss” orders forbidding thousands of its 110,000 troops from returning to the US once their tours of duty are completed. Instead, the troops will remain deployed for a minimum of three additional months. The orders affect troops currently deployed in Iraq, Afghanistan, and Kuwait, as well as soldiers preparing for deployment. [USA Today, 1/5/2004]
The White House announces a new plan for Iraqi governance. It is drastically different from the one unilaterally announced by Coalition Provisional Authority (CPA) administrator L. Paul Bremer two months before (see September 8, 2003). It flip-flops Bremer’s plan, putting a transfer of power to a provisional Iraqi government first, then having elections for an interim government, and finally providing for the drafting and adoption of a new constitution. The head of the Justice Department’s Office of Legal Counsel (OLC), Jack Goldsmith, and OLC lawyer Robert Delahunty, send a classified memo to the Defense Department. The contents of the memo remain secret, but the American Civil Liberties Union (ACLU) will later learn that the memo concerns the Geneva Conventions as they apply to the treatment of detainees in US custody. Presumably, the memo is in reference to previous legal advice submitted to Goldsmith by an OLC attorney-adviser regarding Geneva (see October 31, 2003). Prominent neoconservative Richard Perle, speaking at an event organized by the Institute of Contemporary Arts in London, says of the invasion of Iraq: “I think in this case international law stood in the way of doing the right thing.” According to Perle, who is a member of the Pentagon’s Defense Policy Board, “international law… would have required us to leave Saddam Hussein alone.” [Guardian, 11/20/2003]

[Source: AP / Anja Niedringhaus]President Bush makes a surprise visit to Iraq to have a carefully staged “Thanksgiving dinner with the troops” at the Baghdad International Airport. [White House, 11/27/2003] Most of the 600 or so troops present for the meal are from the Army’s 1st Armored Division and 82nd Airborne units. For security reasons, Bush never leaves the airport, and leaves shortly after the meal. Bush’s entrance is carefully choreographed, with Coalition Provisional Authority head Paul Bremer telling the gathered troops that the most senior official present should read Bush’s Thanksgiving proclamation. Then, turning to a curtained-off area and asking, “Is there anybody back there who’s more senior than us?” Bush enters the area wearing military fatigues. [USA Today, 11/27/2003]
Fake Turkey - Bush poses with a lovely, huge, golden-brown turkey. The turkey is not real, but merely a prop prepared by the food service arm of Kellogg, Brown and Root. The troops actually eat turkey and vegetables from a cafeteria-style steam tray. White House officials later claim not to have known about the enormous decorative bird, and say that Bush’s memorable photo-op of him holding the fake turkey was an impromptu moment that was not planned in advance. Military sources later say that such decorative turkeys are standard features of holiday “chow lines.” [CBS News, 11/27/2003]
Some Soldiers Denied Dinner - Not all the soldiers at the airport are able to eat with the president, or in fact are able to eat at all. In December, Sergeant Loren Russell writes in a letter to Stars & Stripes that soldiers from his unit were denied entrance to the Bob Hope Dining Facility, where Thanksgiving dinner was being served, “because they were in the wrong unit.” Russell writes that his soldiers “understand that President Bush ate there and that upgraded security was required. But why were only certain units turned away? Why wasn’t there a special meal for President Bush and that unit in the new dance hall adjoining the 1st Armored Division’s band building? And all of this happened on Thanksgiving, the best meal of the year when soldiers get a taste of home cooking.” [Stars and Stripes, 1/27/2007]
Secret Flight - The trip to Iraq is conducted under conditions of extreme secrecy; only Laura Bush and a very few top officials are told of the planned visit. Had word leaked of the trip, it would have been canceled. Most White House officials and reporters are told that Bush would spend the holiday at his ranch in Crawford, Texas. Instead, Bush, accompanied by National Security Adviser Condoleezza Rice, is driven away in an unmarked vehicle. At a nearby airport, he boards Air Force One from the back stairs instead of the usual front entrance. After stopping at Andrews Air Force Base outside Washington, where the entourage picks up a few aides, and four reporters and one camera crew sworn to secrecy, the aircraft departs for Iraq. In all, the press corps traveling with the president totals five reporters, five photographers, a TV producer, and a two-person camera crew. All the media members in the group had agreed to surrender their cell phones and wireless e-mail devices beforehand in order to keep them from surreptitiously reporting on the impending trip. Public Relations Effort - According to New York Times columnist and media reporter Frank Rich, the trip was set in motion by the White House’s public relations team and its desire to chase the Chinook tragedy (see November 2, 2003 and November 2, 2003) off the front pages. [Rich, 2006, pp. 110] White House officials say that Bush had been talking about such a visit for weeks, and the final decision to go was reached the day before in a conference call between Bush and Vice President Cheney. [USA Today, 11/27/2003] Journalism professor Jay Rosen later observes that the willing participation of reporters in this kind of event destroys the boundaries between reporters and the subjects they cover. Rosen will write: “The whole notion of the trip as an independently existing thing that could be ‘covered’ is transparently false, as the White House warning to journalists demonstrates. If word leaked out, the trip was to be canceled—it would no longer exist—and the airplane would turn around and head back to Washington. That does not mean the trip was illegitimate to undertake or to treat as news; but it does mean that its potential legitimacy as news event lies outside the logic of ‘things happen and we cover them’ or ‘the president took decisive action and the press reported it.’ Here, the press took action and it was equally decisive. It agreed, first, to go along and record the scene and then to keep the flight a secret; and these decisions by journalists were not incidental to Bush’s decision to go but integral to it. Would the trip have made sense, would the danger have been justified, if reporters and camera crews were not taken along? The answer is clearly no. But this means the press is part of the presidency, an observation that, while true enough, makes it harder to cover the presidency as an independently existing thing.” [PressThink, 12/3/2003]
Negative Reactions - An Army nurse at the American hospital in Landstuhl, Germany, which receives and treats wounded US troops coming from Iraq and Afghanistan, has a different take on Bush’s visit. In an e-mail to the Boston Globe, the nurse, who does not wish her name made public, will write: “My ‘Bush Thanksgiving’ was a little different.… I spent it at the hospital taking care of a young West Point lieutenant wounded in Iraq. He had stabilization of his injuries in Iraq and then two long surgeries here for multiple injuries; he’s just now stable enough to send back to the USA. After a few bites of dinner I let him sleep, and then cried with him as he woke up from a nightmare. When he pressed his fists into his eyes and rocked his head back and forth he looked like a little boy. They all do, all 19 on the ward that day, some missing limbs, eyes, or worse.… It’s too bad Mr. Bush didn’t add us to his holiday agenda. The men said the same, but you’ll never read that in the paper. Mr. President would rather lift fake turkeys for photo ops, it seems. Maybe because my patients wouldn’t make very pleasant photos… most don’t look all that great, and the ones with facial wounds and external fixation devices look downright scary. And a heck of a lot of them can’t talk, anyway, and some never will talk again.… Well, this is probably more than you want to know, but there’s no spin on this one. It’s pure carnage.… Like all wars, the ‘shock and awe’ eventually trickles down to blood and death. But you won’t see that. I do, every single day.” Globe columnist Joan Vennochi will add: “How much of this is enough for the president of the United States? It depends whether the goal is public relations for a presidential campaign or public acknowledgment of the consequences of war—the human consequences. They are convalescing in places like Landstuhl.” [Boston Globe, 12/11/2003] In 2007, author Annia Ciezadlo will recall her Thanksgiving in Baghdad during the same time. Ciezadlo, who spent the holiday with an Iraqi family, will write: “We saw pictures of him later, serving Thanksgiving dinner to American soldiers, posing like a waiter with a great big [turkey] on a tray. He never left the base. ‘You are defeating the terrorists here in Iraq,’ he told the troops, ‘so we don’t have to face them in our own country.’ An Iraqi friend once told me it was that line about fighting in Iraq to make America safer that turned his adoration of Mr. Bush into hatred.” [New York Times, 11/27/2007]

New York Times foreign affairs columnist Thomas Friedman predicts, “The next six months in Iraq—which will determine the prospects for democracy-building there—are the most important six months in US foreign policy in a long, long time.” Friedman will continue predicting a resolution of the Iraq situation in “the next six months” until at least May 2006 (see May 6-11, 2006). Several Middle Eastern countries respond positively to Libya’s pledge to end its weapons of mass destruction programs, including Iran. “Iran welcomes any step taken by any country to dismantle weapons of mass destruction,” says Iranian foreign ministry spokesman Hamid Reza Asefi. “But it is the time for the world to push for Israel’s disarmament, as the main threat to the region,” he adds. Israel reportedly has more than 200 nuclear weapons. [Center for Nonproliferation Studies, 5/1998; BBC, 7/5/2000; BBC, 8/23/2000; BBC, 10/21/2003]
The US-appointed Iraq Governing Council orders the Mujahedeen-e Khalq (MEK) to leave Iraq by the end of year citing its “black history” in Iraq as a “terrorist organization,” a reference to the militant organization’s long history of working with Saddam Hussein (see 1991 and December 2003). But Pentagon officials do not want the MEK to leave Iraq, as they are considering plans to use the group against Iran. [Christian Science Monitor, 12/31/2003]
The neoconservative American Enterprise Institute’s vice president, Danielle Pletka, says that guidelines set by Defense Secretary Donald Rumsfeld in August restricting the Pentagon’s communications with Iranian reformers have hindered analysts’ efforts to collect important information. (see August 2003) “I think information is a commodity we trade in freely in the United States,” she says. “The idea that informational meetings with Iranians should be off-limits to members of our government that deal with nonproliferation and national security seems to me to be foolish in the extreme.” [New York Daily Sun, 12/2/2003]
In an interview with a Pakistani satellite channel, Pakistani nuclear scientist A. Q. Khan denies allegations that he was involved in selling nuclear secrets or equipment to Iran. “I am being accused for nothing, I never visited Iran, I don’t know any Iranian, nor do I know any Iranian scientist,” he says. “I will be targeted naturally because I made the nuclear bomb, I made the missile.” [Guardian, 1/31/2004]
The Mexican government sends a series of diplomatic letters to British Foreign Minister Jack Straw asking the minister if the Government Communications Headquarters (GCHQ) had spied on UN Security Council member states prior to the US-British invasion of Iraq. [Reuters, 2/14/2004; Observer, 2/15/2004] To date, no response has been received. Nor has the British Foreign Office responded to inquiries from the press.
Guantanamo detainee Mohammed Jawad, who has been in custody since he was 16 years old (see December 17, 2002 and January 13, 2009), attempts to commit suicide. Shortly thereafter, Guantanamo guards begin subjecting Jawad to what is known as the “frequent flier” program, in which the detainee is moved from cell to cell every few hours for days or weeks on end, in order to deny him sleep. Jawad is moved 122 times in 14 days, an average of less than 3 hours per move (see June 19, 2008). [Salon, 1/21/2009]
In the wake of the report by US inspector David Kay that Iraq has no weapons of mass destruction (see December 2003), Secretary of State Colin Powell’s mood becomes more and more glum (see February 5, 2003). His chief of staff, Lawrence Wilkerson, will later recall: “Well, [Powell] got a telephone call each time a pillar fell. It was either John [McLaughlin, deputy CIA director], calling Rich [Armitage, Powell’s deputy], and Rich telling him, or it was [CIA Director] George [Tenet] or John calling the secretary. And I remember this vividly because he would walk through my door, and his face would grow more morose each time, and he’d say, ‘Another pillar just fell.’ I said, ‘Which one this time?’ And, of course, the last one was the mobile biological labs (see Mid-March 2004). Finally, when that call came, the secretary came through the door and said, ‘The last pillar has just collapsed. The mobile biological labs don’t exist.’ Turned around and went back into his office.” [Vanity Fair, 2/2009]
The US Army investigates the report of a colonel who documented potential abuses of Iraqi detainees by a joint Special Operations and CIA task force looking for weapons of mass destruction. The report will be made public by the American Civil Liberties Union (ACLU) almost four years later (see August 15, 2007). The ACLU believes the colonel, whose name is redacted from the report, is Colonel Stuart Herrington (see December 12, 2003). The colonel reports that in late November someone called him with details of prisoner abuse that had occurred in June or July 2003 in the vicinity of Baghdad International Airport. The colonel’s source had previously reported the abuse to Major General Keith Dayton, commander of the Iraq Survey Group in charge of the hunt for weapons of mass destruction, and to officials in the Defense Intelligence Agency. The colonel meets with Major General Barbara Fast, the top intelligence officer in Baghdad, to brief her on his investigation into the matter, and gives her a copy of the report. The colonel is subsequently informed that the Judge Advocate General’s office attached to the US command in Iraq found “no evidence to support the allegations that detainees were mistreated.” The colonel believes this conclusion is a “cover-up,” and, in later testimony, will refer to his “blunt dismay” at the finding. He will testify that he cannot understand how his own report could have been taken so lightly given that he had provided names of the witnesses and “already had two people who admitted it.” Fast will later say to the colonel that she never saw his report until mid-2004, a statement that the colonel has trouble believing. Fast will be cleared of all allegations of misconduct by the Army inspector general, who will conclude that she took prompt action to alert the proper authorities once she was informed of the alleged abuse. 9/11 Commission member Jamie Gorelick is given access to the previously sacrosanct Presidential Daily Briefings (PDBs) from the Clinton and Bush administrations (see Early December 2003). Like commission chair Thomas Kean, Gorelick is struck by the general lack of information in the documents (see Early December 2003), but the thing that strikes her most about the PDBs is just how many warnings were given in the months preceding the 9/11 attacks. Details of the predicted terrorist attack were lacking—the US intelligence community did not know where or when the attacks would take place—but the message from the spring, summer, and fall of 2001 was clear: the US must be prepared for a massive assault either on one of its foreign allies or on itself. Gorelick later recalls the warnings say the anticipated attacks are “the worst thing [the US has] ever seen—an unprecedented threat.” The August 6, 2001 PDB (see August 6, 2001) contained warnings about specific threats to American targets, particularly “federal buildings in New York.” Gorelick, like everyone else in the Commission, has never seen the actual August 6 PDB, and she is shocked by the detail and the specificity of the warnings. The characterization of the warnings as “historical” (see May 16, 2002) is inexplicable, she thinks. [Shenon, 2008, pp. 221-222]
Thomas Kean, the chairman of the 9/11 commission, finally gains access to Bill Clinton’s and George W. Bush’s Presidential Daily Briefings (PDBs). Co-chairman Lee Hamilton calls the PDBs the “holy of holies.” They are documents that the Bush administration has worked relentlessly to keep out of the commission’s hands. Kean assumes that the documents are chock full of critical information. “I thought this would be the definitive secrets about al-Qaeda, about terrorist networks, and all the other things that the president should act on,” Kean will later recall. “I was going to find out the most important things that a president had learned.” Kean believes the PDBs should contain “incredibly secretive, precise, and accurate information about anything under the sun.” When he begins reading through the PDBs, he finds that the documents are not what he expected. He finds that they contain almost nothing of use. The realization terrifies him—these digests of the most important, sensitive secrets garnered by the US intelligence community, at a cost of tens of billions of dollars per year, used by the president to base his actions and decisions upon, are, in Kean’s words, “garbage.” He continues, “There really was nothing there—nothing, nothing.” Had his students at Drew University turned in terms papers this poorly researched, he says, “I would have given them an F.” There are a few snippets of solid information among the dross, tidbits about al-Qaeda and other terrorist groups. Occasionally, something intriguing catches Kean’s attention, for instance a report of a sighting of Osama bin Laden or a tip from a foreign intelligence service about possible future actions by a terrorist group. But most of the PDB contents could have been gleaned from reading the newspaper. Author Philip Shenon will write: “Perhaps the reason why the White House had fought so hard to block the commission’s access to the PDBs was that they revealed how ignorant the government was of the threats it faced before 9/11. Kean could understand their fear. Imagine the consequences if al-Qaeda and its terrorist allies knew how little the United States really knew about them.” [Shenon, 2008, pp. 220-221] 9/11 Commissioner Jamie Gorelick also sees the same PDBs around the same time, and while she also is surprised by the lack of detail, she is more surprised at how alarming the warnings about an al-Qaeda attack are (see Early December 2003).
Peter Bergen. [Source: Peter Bergen]Author and former war correspondent Peter Bergen writes that in the run-up to the Iraq war, most Americans believed wholeheartedly that Saddam Hussein and Iraq were behind the 9/11 attacks. Bergen writes: “[T]he belief that Saddam posed an imminent threat to the United States amounted to a theological conviction within the administration, a conviction successfully sold to the American public. So it’s fair to ask: Where did this faith come from?” One source is the American Enterprise Institute (AEI), a neoconservative think tank who has placed many of its fellows in the Bush administration, including Paul Wolfowitz, Richard Perle, and John Bolton. But, Bergen notes, none of the AEI analysts and writers are experts on either Iraq or the Middle East. None have ever served in the region. And most actual Middle East experts both in and out of government don’t believe that Iraq had any connection to the 9/11 attacks. The impetus for the belief in a 9/11-Iraq connection in part comes from neoconservative academic Laurie Mylroie.
Mylroie Supplies Neoconservatives with Desired Rationale - A noted author with an impressive academic resume, Mylroie, Bergen writes, “was an apologist for Saddam’s regime, but reversed her position upon his invasion of Kuwait in 1990, and, with the zeal of the academic spurned, became rabidly anti-Saddam.” In 1993, Mylroie decided that Saddam Hussein was behind the World Trade Center bombings, and made her case in a 2000 AEI-published book, Study of Revenge: Saddam Hussein’s Unfinished War Against America (see October 2000). Mylroie’s message was evidently quite popular with AEI’s neoconservatives. In her book, Mylroie blamed every terrorist event of the decade on Hussein, from the 1993 WTC bombings (a theory Bergen calls “risible”) to the 1996 crash of TWA Flight 800 into Long Island Sound (see July 17, 1996-September 1996), the 1998 embassy bombings in Tanzania and Kenya (see 10:35-10:39 a.m., August 7, 1998), the 2000 attack on the USS Cole (see October 12, 2000), and even the 1995 Oklahoma City bombings (see 8:35 a.m. - 9:02 a.m. April 19, 1995). Bergen calls her a “crackpot,” and notes that it “would not be significant if she were merely advising say, [conservative conspiracy theorist] Lyndon LaRouche. But her neocon friends who went on to run the war in Iraq believed her theories, bringing her on as a consultant at the Pentagon, and they seem to continue to entertain her eccentric belief that Saddam is the fount of the entire shadow war against America.”
Complete Discrediting - Bergen, after detailing how Mylroie ignored conclusive evidence that both the 1993 and 9/11 attacks were planned by al-Qaeda terrorists and not Saddam Hussein, quotes former CIA counterterrorism chief Vincent Cannistraro, who says Mylroie “has an obsession with Iraq and trying to link Saddam to global terrorism.” Cannistraro is joined by author and former CIA analyst Ken Pollack; Mary Jo White, the US attorney who prosecuted the 1993 WTC bombings and 1998 embassy attacks; and Neil Herman, the FBI official who headed the 1993 WTC investigation, who all dismiss Mylroie’s theories as absolutely baseless and thoroughly disproven by the evidence.
Belief or Convenience? - Apparently such thorough debunking did not matter to the AEI neoconservatives. Bergen writes that they were “formulating an alternative vision of US foreign policy to challenge what they saw as the feckless and weak policies of the Clinton administration. Mylroie’s research and expertise on Iraq complemented the big-think strategizing of the neocons, and a symbiotic relationship developed between them.” Whether the neoconservatives actually believed Mylroie’s work, or if “her findings simply fit conveniently into their own desire to overthrow Saddam,” Bergen isn’t sure. Perle later backed off of supporting Mylroie’s theories, calling them less than convincing and downplaying her role in developing arguments for overthrowing Hussein even as he suggests she should be placed in a position of power at the CIA. It is known that after 9/11, former CIA Director James Woolsey, a prominent neoconservative, went to Britain to investigate some of Mylroie’s claims (see Mid-September-October 2001). And in September 2003, Vice President Cheney called Iraq “the geographic base of the terrorists who have had us under assault for many years, but most especially on 9/11,” an echoing of Mylroie’s own theories. Mylroie’s latest book, Bush vs. the Beltway: How the CIA and the State Department Tried to Stop the War on Terror, accuses those agencies of suppressing information about Iraq’s role in 9/11, again contradicting all known intelligence and plain common sense (see July 2003).
Zeitgeist - Bergen concludes that in part because of Mylroie’s theories and their promulgation by Bush, Cheney, and prominent neoconservatives in and out of the administration, the US has been led into a disastrous war while 70 percent of Americans believe that Hussein had a role in the 9/11 attacks. “[H]er specious theories of Iraq’s involvement in anti-American terrorism have now become part of the American zeitgeist.” Perhaps the most telling statement from Mylroie comes from a recent interview in Newsweek, where she said: “I take satisfaction that we went to war with Iraq and got rid of Saddam Hussein. The rest is details.” Bergen retorts sourly, “Now she tells us.” [Washington Monthly, 12/2003; Unger, 2007, pp. 216]

Coalition Provisional Authority administrator L. Paul Bremer (see May 1, 2003) asserts his independence from US government oversight, a stance assisted by Defense Secretary Donald Rumsfeld. Bremer is formally slated to report to Rumsfeld, but says Rumsfeld has no direct authority over him. Instead, Bremer insists, he reports directly to the White House. Rumsfeld, usually jealously protective of his bureaucratic prerogatives, tells National Security Adviser Condoleezza Rice: “He doesn’t work for me. He works for you” (see Late September, 2003). But Bremer is not willing to report to either Rice or the National Security Council (NSC) either. The White House had already announced that it had no intention of playing a large role in guiding the reconstruction of Iraq, and the NSC’s Executive Steering Group, set up in 2002 to coordinate war efforts, has been dissolved. Finally, Bremer flatly refuses to submit to Rice’s oversight. As a result, Bremer has already made fundamental policy shifts on his own authority that are at odds with what Pentagon planners had intended (see May 16, 2003 and May 23, 2003), with what many feel will be—or already have caused—disastrous consequences. The American Academy of Arts and Sciences publishes a study, titled “War with Iraq: Costs, Consequences, and Alternatives,” in which one of its authors, D. Nordhaus of Yale University, writes that the Bush administration’s planned invasion of Iraq and post-invasion occupation could cost anywhere from $99 billion to more than $1.9 trillion over a decade. The study notes that the macroeconomic cost of such a military operation could be as high as $400 billion as a result of a disruption in oil markets and an ensuing recession. As part of the difficult negotiations between the US, North Korea, and four regional partners to try to bring the North Korean nuclear program under restraint (see August 2003), the Chinese delegation offered a joint statement that would show some progress, however limited, has been made. The US refuses to sign, balking at language that recognizes US-North Korean relations are founded on “the intention to coexist.” Vice President Dick Cheney explains the US rejection: “I have been charged by the president with making sure that none of the tyrannies of the world are negotiated with” (see December 19, 2003). [Source: BBC]Saddam Hussein is captured by US forces, in an operation given the title of “Red Dawn.” Hussein is hiding in a tiny cellar at a farmhouse in Adwar, a village south of his hometown of Tikrit. Coalition Provisional Authority administrator L. Paul Bremer announces Hussein’s capture to a group of journalists by saying: “Ladies and gentlemen, we got him.… The tyrant is a prisoner.” According to soldiers present at the capture, Hussein put up no resistance. Iraqi Governing Council head Abdul Aziz al-Hakim says a DNA test proves the man in custody is indeed Saddam Hussein.
Reactions from Western Leaders - US President George W. Bush calls Hussein’s capture “good news,” and White House spokesman Scott McClellan says, “The Iraqi people can finally be assured that Saddam Hussein will not be coming back—they can see it for themselves.” British Prime Minister Tony Blair says Hussein’s capture “removes the shadow” hanging over Iraq. “Where his rule meant terror and division and brutality, let his capture bring about unity, reconciliation and peace between all the people of Iraq.”
Tip from Clan Member Leads to Capture - US military spokesman Major General Raymond Odierno says Hussein was captured within 24 hours of US forces receiving a tip as to Hussein’s whereabouts from a member of his clan. “He was caught like a rat,” says Odierno. “It was ironic that he was in a hole in the ground across the river from the great palaces he built using all the money he robbed from the Iraqi people.” Of the tip, Odierno says: “Over the last 10 days we brought in about five to 10 members of these families, and finally got the ultimate information from one of these individuals.… This was not something that happened overnight. Since we have been [in Iraq] we have collected a lot of intelligence. We always knew that he was relying on family and tribal ties.” It is not known whether that clan member will receive the $25 million offered by the US for information leading to Hussein’s capture. Odierno describes Hussein as “very much bewildered,” and notes that when Hussein was captured, he said “hardly anything at first.” He is described by US officials as polite and cooperative in his captivity.
'Spider Hole' - Hussein’s hiding place, characterized by some US spokesmen as a “spider hole,” was a small hut with two rooms: a bedroom cluttered with clothes, and a kitchen with running water. [BBC, 12/14/2003; Fox News, 12/14/2003] The hut contains some $750,000 in US money. [Christian Science Monitor, 12/15/2003] The cellar where Hussein is found is a tiny, rough-dug hiding place, with a styrofoam cover and a tube to allow air in.
Iraqis Celebrate - In the northern Kurdish town of Kirkuk, people celebrate the news of Hussein’s capture and arrest by blowing their automobile horns and firing guns into the air. [BBC, 12/14/2003; Fox News, 12/14/2003] “We are celebrating like it’s a wedding,” says one Kirkuk resident. “We are finally rid of that criminal.”
Council Members: Hussein Will Stand Trial; Capture Will Bring End to Terrorism in Iraq - Iraqi Governing Council member Ahmed Chalabi says Hussein will be put on trial. “Saddam will stand a public trial so that the Iraqi people will know his crimes,” Chalabi says. Fellow council member Jalal Talabani says that with Hussein’s capture, terrorism in Iraq will cease: “With the arrest of Saddam, the source financing terrorists has been destroyed and terrorist attacks will come to an end. Now we can establish a durable stability and security in Iraq.” [Fox News, 12/14/2003]
The existence of a June 2002 memo—revealing that intelligence from the Iraqi National Congress (INC) was being sent directly to the offices of Vice President Dick Cheney and William Luti—is reported in Newsweek magazine, which also reports that Francis Brooke, a DC lobbyist for the INC, admits having supplied Cheney’s office with information pertaining to Iraq’s alleged arsenal of weapons of mass destruction and Saddam’s supposed ties to militant Islamic groups. [Newsweek, 12/15/2003 Sources: Memo, Francis Brooke] Furthermore, he acknowledges that the information provided by the INC was driven by an agenda. “I’m a smart man. I saw what they wanted, and I adapted my strategy,” he later admits. “I told them [the INC], as their campaign manager, ‘Go get me a terrorist and some WMD, because that’s what the Bush administration is interested in.’” [Vanity Fair, 5/2004, pp. 230; New Yorker, 6/7/2004] Brooke had previously worked for the Rendon Group, “a shadowy CIA-connected public-relations firm.” [Mother Jones, 1/2004] However, an unnamed Cheney aid interviewed by the same magazine flatly denies that his boss’ office had received raw intelligence on Iraq. Among other topics addressed, he reaffirms his belief that terrorists operated in Iraq before the March 2003 invasion (citing Ansar al-Islam, “a al-Qaeda affiliate, I would call them al-Qaeda, was active in Iraq before the war, hence—a terrorist tie with Iraq…”) and that his insistence that Iraq had an active and threatening WMD program was based on “good solid intelligence[, t]he same intelligence that my predecessor [Bill Clinton] operated on.” [ABC News, 12/17/2003] In 2004, former Nixon White House counsel John Dean will respond, “His predecessor, however, never claimed that Saddam [Hussein] had imminent… nuclear capacity, nor did his predecessor say that Iraq had ties to al-Qaeda.” [Dean, 2004, pp. 153]
Iraq Had WMD Program, Bush Insists - Bush insists that weapons inspector David Kay proved Iraq did have a burgeoning and active WMD program (see October 2, 2003), and implies that it is just a matter of time before the actual weapons are found. Sawyer says, “But stated as a hard fact, that there were weapons of mass destruction as opposed to the possibility that he could move to acquire those weapons still,” to which Bush replies, “So what’s the difference?” Sawyer appears taken aback by the answer, and Bush continues that since it was possible Hussein would acquire WMDs, it was necessary to “get rid of him” to make “the world a safer, freer place.” Sawyer presses the point home: “What would it take to convince you he didn’t have weapons of mass destruction?” and Bush responds: “Saddam Hussein was a threat. And the fact that he is gone means America is a safer country.” Sawyer asks, “And if he doesn’t have weapons of mass destruction?” and Bush replies tartly: “Diane, you can keep asking the question. I’m telling you, I made the right decision for America. Because Saddam Hussein used weapons of mass destruction, invaded Kuwait (see August 2, 1990). But the fact that he is not there is, means America’s a more secure country.” [ABC News, 12/17/2003] White House press secretary Scott McClellan will later write, “Bush’s response was telling, much more so than I stopped to contemplate at the time.” [McClellan, 2008, pp. 200]
Why Read the News? - Sawyer asks Bush about his reported penchant for not reading the news for himself. Bush confirms that he gets his news from National Security Adviser Condoleezza Rice and White House chief of staff Andrew Card, who, Sawyer says, “give you a flavor of what’s in the news.” Bush agrees that this is the case, and says: “Yeah. I get my news from people who don’t editorialize. They give me the actual news. And it makes it easier to digest, on a daily basis, the facts.” Sawyer asks, “Is it just harder to read constant criticism or to read?” to which Bush replies: “Why even put up with it when you can get the facts elsewhere? I’m a lucky man. I’ve got, it’s not just Condi and Andy. It’s all kinds of people in my administration who are charged with different responsibilities. And they come in and say, ‘this is what’s happening, this isn’t what’s happening.’” Laura Bush, who joins her husband halfway through the interview, says she reads the newspapers, including the opinion columns, but says: “I agree with him that we can actually get what is really happening from the people who really know what’s happening. And that isn’t always what you get in the newspapers.… There are certain columnists I won’t read. I mean, what, you know, why would I?” [ABC News, 12/17/2003]
Wilson: Bush 'Systematically Deceived' US, 'Betrayed' Military - Months later, former ambassador Joseph Wilson will write: “It was clear, from this one statement, […] that the administration, from the president on down, had systematically deceived the American people, Congress, and the world. Most of all, the president had betrayed the soldiers, sailors, airmen, and Marines who so bravely march out when ordered into war to defend our country against immiment threats, or even from grave and gathering dangers. Iraq had posed neither. The difference, Mr. President, I thought, is that war was not the only option, or even the best one. We had gone to war over capacity, not stockpiles, not mushroom clouds (see September 4, 2002), not intent, or, as John Bolton had earlier said more directly, because scientists were on Saddam’s payroll. Our troops had died—and were continuing to die—in vain. I came away from this sad revelation resolved that, unlike the other bitterly divisive war debate of my lifetime, over the war in Vietnam, we should admit this terrible fact sooner, rather than later, and thereby revise our national policies accordingly.” [Wilson, 2004, pp. 414-415]

A three-judge panel of the Second US Circuit Court of Appeals in New York votes two to one that the military must either charge alleged al-Qaeda terrorist Jose Padilla with a crime, or release him within 30 days. “The government,” the court says, “can transfer Padilla to appropriate civilian authorities who can bring criminal charges against him.” Until now, no court in the US has ruled against the government’s contention that even American citizens arrested on US soil can be held indefinitely based on wartime government prerogatives. Neither the 2001 Authorization to Use Military Force (see September 14-18, 2001) nor the president’s “inherent power” as commander in chief is enough to hold Padilla without a trial, the court finds: “The president, acting alone, possesses no inherent constitutional authority to detain American citizens seized within the United States, away from a zone of combat, as enemy combatants.” The two judges in the majority are a 1998 Clinton appointee and a 2001 Bush appointee; the dissenter, who advocates granting the president new and sweeping powers, is a 2003 Bush appointee. “So far,” Office of Legal Counsel lawyer John Yoo comments, “the Second Circuit is the only court that has rejected the idea that the war on terrorism is, in fact, a war.” Because this ruling conflicts with the Fourth Circuit’s ruling in favor of the Bush administration, the Supreme Court will be forced to resolve the issue (see June 28, 2004); in light of the appeal, the court later agrees to suspend its 30-day ruling. Neoconservative Michael Ledeen, in an op-ed piece published by the Wall Street Journal, makes numerous charges against the Iranian government, saying it supports terrorism and is on the verge of developing a nuclear weapon. He asserts that the Bush administration must therefore act soon against Iran. He says Iran is the “ultimate litmus test of the seriousness of the Bush administration” and that the administration’s “ability to conduct an effective campaign against the mullahs in Tehran will determine the outcome of the war against the terror masters.” Ledeen asserts that the US does not need to invade Iran to “liberate it,” rather it only needs to support the “enthusiastically pro-American” people, as the US did the “Serbs against Slobodan Milosovic, the Filipinos against the Marcoses, the Poles against Soviet Communism.” [Wall Street Journal, 12/19/2003]
Vice President Cheney, discussing the administration’s refusal to negotiate with North Korea, sums up its policy quite bluntly. “I have been charged by the president with making sure that none of the tyrannies in the world are negotiated with,” he says. “We don’t negotiate with evil; we defeat it.” Cheney is primarily responsible for rejecting a joint statement acknowledging North Korea’s right to exist as an independent nation, a precondition for North Korea to resume negotiations (see December 12, 2003). However, a Bush administration spokesman blames North Korea, not the US, for refusing to engage, and says the administration is willing to negotiate “without any preconditions.” Cheney insisted that North Korea agree to dismantle its nuclear program before any negotiations could begin. According to a senior Bush official, a North Korean negotiator has complained that the US demands are the equivalent of “you… telling me to take off all my clothes and walk out in a snowstorm and you promise you will come running with a coat. I don’t think so. You want me to go naked into the night.” [Knight Ridder, 12/19/2003; Scoblic, 2008, pp. 234]
Libya announces that it is giving up its unconventional weapons and ballistic missile programs in response to recent negotiations with the US and Britain. Thousands of nuclear reactor components are taken from a site in Tripoli and shipped to the Oak Ridge National Laboratory in Tennessee. Later examination shows that the Libyans had made little progress towards developing any sort of nuclear program. Nevertheless, it is a significant breakthrough in the Bush administration’s relations with Muslim nations considered to be inimical to Western interests.
'Scared Straight'? - Bush administration officials declare that the Libyan government “caved” under American pressure and because of the US-led invasion of Iraq; because Libyan leader Mu’ammar al-Qadhafi had approached the US shortly before the invasion of Iraq, it is plain that al-Qadhafi had been “scared straight” by the belligerent US approach to Middle Eastern affairs. In 2008, author J. Peter Scoblic will call that characterization “useful, if wishful.” The threat of a Libyan WMD program was sketchy at best, regardless of Bush officials’ insistence that the US had forced the disarmament of a dangerous foe. But, Scoblic will write, the Libyan agreement serves as “a retroactive justification of an invasion whose original rationale had become increasingly dubious.” The Libyan agreement also “seemed to prove that conservatives could solve rogue state problems in a morally pure but nonmilitary way—that they did not have to settle for containment or the distasteful quid pro quo that had characterized deals like Clinton’s 1994 Agreed Framework with North Korea (see October 21, 1994). They could simply demand disarmament.”
Negotiating Disarmament Since 1999 - The reality of the Libyan agreement is far different from the Bush interpretation. Al-Qadhafi’s government has for years wanted to get out from under UN sanctions imposed after Libyan hijackers bombed a Pan Am flight over Lockerbie, Scotland in 1988. Since 1999, the US and Britain have been negotiating with Libya, with the ultimate aim of lifting sanctions and normalizing relations. President Clinton’s chief negotiator, Martin Indyk, said that “Libya’s representatives were ready to put everything on the table” during that time. Bush officials, after an initial reluctance to resume negotiations, were reassured by Libya’s offer of support and assistance after the 9/11 attacks, and resumed discussions in October 2001. Al-Qadhafi himself offered to discuss disarmamement with the British in August 2002. Negotiations opened in October 2002. With the Iraq invasion looming, the Libyans held up further negotiations until March 2003; meanwhile, Vice President Cheney warned against striking any deals with the Libyans, saying that the US did not “want to reward bad behavior.” The negotiations resumed in March, with efforts made to deliberately keep State Department and Pentagon neoconservatives such as John Bolton and Paul Wolfowitz in the dark “so that,” Scoblic will write, “administration conservatives could not sabotage a potential deal.” The negotiations were led by the CIA and MI6. (Bolton attempted to intervene in the negotiations, insisting that “regime change” in Libya was the US’s only negotiating plank, but high-level British officials had Bolton removed from the process and gave al-Qadhafi reassurances that Bolton’s stance was not reflective of either the US or Britain’s negotiating position.)
Pretending that Libya 'Surrendered' - After the deal is struck, administration conservatives attempt to put a brave face on the deal, with Cheney saying: “President Bush does not deal in empty threats and half measures, and his determination has sent a clear message. Just five days after Saddam [Hussein] was captured (see December 14, 2003), the government of Libya agreed to abandon its nuclear weapons program and turn the materials over to the United States.” Administration officials insist that there had been no negotiations whatsoever, and Libya had merely capitulated before the American display of military puissance. “It’s ‘engagement’ like we engaged the Japanese on the deck of the Missouri in Tokyo Bay in 1945,” one administration official boasts. “The only engagement with Libya was the terms of its surrender.” And Bush officials claim that the Libyans gave up their weapons with no terms whatsoever being granted them except for a promise “only that Libya’s good faith, if shown, would be reciprocated.” That is not true. Bush officials indeed made significant offers—that the US would not foment regime change in Libya, and that other “quid pro quo” terms would be observed.
Thwarting Conservative Ideology - Scoblic will conclude: “Left unchecked, the administration’s ideological impulses would have scuttled the negotiations. In other words, for its Libya policy to bear fruit, the administration had to give up its notion that dealing with an evil regime was anathema; it had to accept coexistence even though al-Qadhafi continued to violate human rights. Libya is thus the exception that proves the rule.” [Scoblic, 2008, pp. 251-255]

Over a period of months, Piro uses a combination of friendliness, warmth, and verbal provocations to tease a wealth of information from Hussein. At no time does Piro or other FBI interrogators use “aggressive” or “harsh” interrogation methods against Hussein. Piro works closely with a team of FBI and CIA analysts to pore over Hussein’s responses. He will later recall his sessions with Hussein for CBS News interviewer Scott Pelley.
'Mr. Saddam' - Piro begins calling the dictator “Mr. Saddam,” as a sign of respect; by the end of their time, they are on a first-name basis with one another. Hussein never finds out that Piro is “just” an FBI agent; he believes that Piro is far more influential than he actually is, and is directly briefing President Bush on their conversations. “He didn’t know I worked for the FBI, he didn’t know I was a field agent,” Piro will recall. Had he found out, “I think initially he would have been angry. He would feel that I was way beneath him, and would not respond well to the interrogation. Or even to me.… I think he thought, and actually on a couple of occasions talked around the issue that I was directly answering to the president.” Piro will recall setting several strategies of deception into motion, including his barking orders at the guards to send them into a panic to obey his instructions. “[I]t was all part of our strategy,” Piro will explain.
Controlling the Dictator - Piro will say that he gained physical control of the setting—a small, windowless room with chairs and a table—merely by placing himself between Hussein and the door. “I purposely put his back against the wall,” Piro will recall. “And then mine against the door, psychologically to tell him that his back was against the wall in the interview room. And that I stood between him and the door, psychologically. Between him whether it’s to go back to his cell, freedom, whatever he was projecting to be outside of that door. I was kind of that psychological barrier between him and the door.” Piro will add, “I basically said that I was gonna be responsible for every aspect of his life, and that if he needed anything I was gonna be the person that he needed to talk to.” Piro controls Hussein’s food and cleaning materials—Piro will describe Hussein as a “clean freak” who uses large numbers of baby wipes to disinfect his cell and his food. Piro allows Hussein pen and paper to write what Piro will describe as inordinate amounts of “terrible” poetry. “We had the guards remove their watches,” Piro will recall. “And the only person that was wearing a watch was me. And it was very evident to him, ‘cause I was wearing the largest wristwatch you could imagine. And it was just the act of him asking for the time—was critical in our plan.” Pelley says, “So you controlled time itself,” and Piro answers, “Yes.”
No Coercive Interrogation Methods - Piro will say that no coercive interrogations, such as sleep deprivation, excessive heat or cold, bombardment with loud music, or waterboarding are ever used. “It’s against FBI policy, first,” Piro will explain. “And wouldn’t have really benefited us with someone like Saddam.… I think Saddam clearly had demonstrated over his legacy that he would not respond to threats, to any type of fear-based approach.” The best methods for use with Hussein are, according to Piro, time and patience.
Using Emotions to Create Vulnerability - Piro uses their time to build a relationship with Hussein based on dependency, trust, and emotion. He alternates between treating Hussein with courtesy and kindness, and provoking him with pictures and video images designed to anger and embarrass the former dictator. He uses pictures of the toppling of Hussein’s statues and news videos documenting his overthrow. “I wanted him to get angry. I wanted him to see those videos and to get angry,” Piro will say. “You want to take him through those various emotions. Happy, angry, sad. When you have someone going through those emotions they’re not able to really control themselves. And they’re more vulnerable during the interview.”
Insult Drove Kuwait Invasion - Piro learns that one of the driving forces behind Hussein’s invasion of Kuwait in 1990 (see August 2, 1990) was personal insult. “What really triggered it for him, according to Saddam, was he had sent his foreign minister to Kuwait to meet with the Emir Al Sabah, the former leader of Kuwait, to try to resolve some of the… issues” between Kuwait and Iraq, Piro will recall. “And the Emir told the foreign minister of Iraq that he would not stop doing what he was doing until he turned every Iraqi woman into a $10 prostitute. And that really sealed it for him, to invade Kuwait. He wanted to punish, he told me, Emir Al Sabah, for saying that.” The 1991 US invasion of Iraq (see January 16, 1991 and After) soured Hussein on then-President George H. W. Bush, a feeling that Hussein transferred to the son. “He didn’t like President [George W.] Bush,” Piro will say. “He would have liked meeting President Reagan. He thought he was a great leader. Honorable man. He liked President Clinton. But he did not like President Bush, the first or the current.”
Small Things, Big Impact - Piro will recall the outsized impact relatively small incidents have on Hussein. One night the FBI flies Hussein to a hospital. He is manacled and blindfolded. Piro will remember: “And once I saw how beautiful Baghdad was in the middle of the night, so I took advantage of it. I allowed him to look out and the lights were on. There was traffic. And it looked like any other major metropolitan city around the world. And for him to see that. And as I mentioned, you know, big Baghdad is moving forward without you. I mean, little things like that didn’t require a lot of suggestion on our part. It made its point.” Piro even uses Hussein’s birthday, a former national holiday, to drive home his point. “In 2004, no one celebrated his birthday on April 28th. So the only one that really knew and cared was us. I’d brought him some cookies, and we, the FBI, celebrated his birthday for him.” Piro gives Hussein packets of flower seeds and allows him to plant his own small garden, which he must tend with his hands because the FBI will not allow him to use tools. Piro will recall that their strolls in Hussein’s tiny garden are often the site of large revelations.
Avoiding Capture - Hussein tells Piro that US forces simply missed him during the first days of the invasion, the “shock and awe” assault. “He said that he was at one of the locations. He said it in a kind of a bragging fashion, that he was there, but that we missed him,” Piro later says. “He told me he changed the way he traveled. He got rid of his normal vehicles. He got rid of the protective detail he traveled with. Really just to change his signature so he would be much harder to identify.” And Hussein denies ever using body doubles or decoys, as US intelligence had long asserted.
WMD - Five months into the sessions, Hussein finally opens up to Piro regarding the subject of Iraq’s WMD programs. Using indirection, Piro begins to tease information out of Hussein. “He told me that most of the WMD had been destroyed by the UN inspectors in the ‘90s. And those that hadn’t been destroyed by the inspectors were unilaterally destroyed by Iraq,” Piro will recall. So why, Pelley will ask, did Hussein “put your nation at risk, why put your own life at risk to maintain this charade?” Piro will respond: “It was very important for him to project that because that was what kept him, in his mind, in power. That capability kept the Iranians away. It kept them from reinvading Iraq.” It is apparent, Piro says, that Hussein did not believe he could survive without the perception that he had WMD. But Piro confirms that Hussein always intended to restart his WMD program someday. “The folks that he needed to reconstitute his program are still there,” Piro will observe. “He wanted to pursue all of WMD. So he wanted to reconstitute his entire WMD program.”
Did Not Believe US Would Invade - From there, Hussein begins to explain why he let the US continue to believe he had such weapons even as troops began massing on his borders. He didn’t believe the US would actually invade, he says. As Piro will recall: “[H]e told me he initially miscalculated President Bush. And President Bush’s intentions. He thought the United States would retaliate with the same type of attack as we did in 1998 under Operation Desert Fox (see December 16-19, 1998). Which was a four-day aerial attack. So you expected that initially.” Hussein says that Iraq would have survived a relatively limited aerial bombardment. “He survived that once,” Piro will recall. “And then he was willing to accept that type of attack. That type of damage.” But he never believed the US would invade until almost the moment of the initial assault.
'The Secret War' - Hussein knew his military could not win in any confrontation with the US. Instead, as Piro will recall: “What he had asked of his military leaders and senior government officials was to give him two weeks. And at that point it would go into what he called the secret war.… Going from a conventional to an unconventional war.” Pelley will remark, “So the insurgency was part of his plan from the very beginning,” to which Piro will say, “Well, he would like to take credit for the insurgency.”
Iraq and al-Qaeda - Hussein confirms that his regime had no dealings with al-Qaeda, as many Bush officials have long believed. Hussein considered Osama bin Laden “a fanatic,” according to Piro. “You can’t really trust fanatics,” Hussein tells the interrogator. And he had no interest in any alliance with al-Qaeda. “He didn’t wanna be seen with bin Laden,” Piro will recall. “And didn’t want to associate with bin Laden.” Hussein viewed bin Laden as a threat to him and his regime.
Independent Confirmation and Praise for Piro's Efforts - Hussein’s claims are later verified by independent interrogations with other high-ranking Hussein regime officials. Piro’s boss, FBI Assistant Director Joe Persichini, will say that Piro’s interrogation is a high mark of the bureau’s recent efforts. “The FBI will be celebrating its 100th anniversary this year and I would have to say that the interview with Saddam Hussein is one of the top accomplishments of our agency in the last 100 years,” Persichini will say, and gives credit to Piro’s language skills. Only about 50 of the 10,000 FBI agents speak Arabic, he will note. Piro will credit his FBI and CIA colleagues for their work in analyzing Hussein’s statements, and their extensive knowledge of Hussein and his regime. “The more you know about your subject, the better of an interview… that you’re gonna conduct,” he will say. “You’ll be able to recognize inconsistencies, deception, things like that. Plus it really establishes your credibility within the interview.”
No Regrets - One thing Hussein never shows during his long interviews, Piro later recalls, is remorse. “No remorse,” Piro will say. “No regret.” [CBS News, 1/27/2008]

Michael Scheuer, the former head of the CIA’s Bin Laden unit, writes in the introduction to his book Imperial Hubris, “The US invasion of Iraq was not preemption; it was—like our war on Mexico in 1846—an avaricious, premeditated, unprovoked war against a foe who posed no immediate threat but whose defeat did offer economic advantages.” [Scheuer, 2005, pp. xvi-xvii]
General Electric does about $270 million in business in Iran through one of its foreign subsidiaries. The company has sold Iran hydroelectric equipment, medical equipment, and oil and gas equipment. Under current US law, companies are barred from doing business with nations that the US State Department has said are sponsors of terrorism. However the law does not prohibit a company’s foreign subsidiaries from engaging in such business. [Associated Press, 2/2/2005]
Iran, despite being OPEC’s second largest oil exporter, is forced to import a billion dollars worth of gasoline due to demand outstripping the country’s limited refining capacity. “We use 50 million liters of fuel each day, 10 percent more than just a year ago,” Seyyed Reza Kasaizadeh, planning director for the national refining and distribution company NIORDC, tells the Persian daily Khorasan. Roughly a quarter of that amount is purchased by the government on the open market, and then sold to the public at the same subsidized price as domestically refined fuel—roughly 35 cents per gallon. [Iran Daily, 12/12/2004] In addition to the subsidy program’s actual costs, the program also represents “a huge opportunity cost, because they could be selling that at world prices,” Ben Faulks, an analyst for the London-based Economist Intelligence Unit, tells the Washington Post in mid-2005. Iran hopes that its nuclear energy program will solve this problem by reducing the country’s industrial oil consumption needs. The country would then be able to sell more of its oil at market prices and substantially increase its revenue. [Washington Post, 7/4/2005]
An unidentified US telecommunications firm refuses to turn over its phone records to the government as part of a joint program by the NSA and the Drug Enforcement Agency to combat Latin American drug-trafficking that has been going on since the 1990s (see 1990s). The firm believes the administrative subpoenas issued for its information by the Justice Department are overly broad, and that it fears the public relations and legal backlashes it might suffer if the public were to learn of its cooperation. The Bush administration directs the Department of Homeland Security to seize any vessel, sailing anywhere in US waters, that DHS believes might be headed to Cuba. The justification for the directive is “the Cuban government’s support of terrorism,” according to the DHS, even though there is little evidence to back up that claim. According to Business Week’s Paul Magnusson, the directive may well violate the Bill of Rights, and requires the US Coast Guard to “draw up regulations and enlist cash-strapped local police departments and harbor patrols in the effort.” The editor of a boating magazine observes: “That’s right, Popeye. If you’re unlucky enough to be reading this magazine in the cockpit of your most cherished possession—be it in San Diego, Seattle, Saginaw, or South Florida—and you wonder aloud how you’d always wanted to chase Hemingway’s wake, by the letter of this new edict you have now forfeited the right to keep your boat.” [Carter, 2004, pp. 17]
Members of the 9/11 Commission’s team focusing on counterterrorism issues are appalled at a rewrite of a report by executive director Philip Zelikow. Zelikow rewrote the report, about the history of US efforts to contain al-Qaeda during the Clinton years, to imply that direct links exist between Iraq and al-Qaeda (see January 2004). Staffer Scott Allan, who wrote the original report, thinks that if the report is allowed to stand, it will become an important propaganda tool for the White House and its neoconservative backers in justifying the Iraq war, with headlines trumpeting the commission’s “discovery” of evidence linking al-Qaeda and Iraq. Many of Allan’s colleagues are equally disturbed, especially senior staffer Les Hawley. Hawley, a retired colonel, is a veteran of the military and civilian bureaucracies in Washington, and was a senior official in the State Department under Bill Clinton. Hawley, Allan, and the rest of the team directly challenge Zelikow’s rewrite. In author Philip Shenon’s words: “It would be remembered as an all-important showdown for the staff, the moment where they would make it clear that Zelikow could take his partisanship only so far. The staff would not allow him to trade on their credibility to promote the goals of the Bush White House—not in these interim reports, nor in the commission’s final report later that year.” The staff soon confronts Zelikow on the issue (see January 2004). After 9/11 Commission executive director Philip Zelikow rewrites a staff report to allege links between Iraq and al-Qaeda (see January 2004), the staff confront Zelikow over the rewrite (see January 2004). The meeting between Zelikow and the staffers becomes somewhat heated, but Zelikow capitulates in the end, replacing the allegations of a link between Iraq and al-Qaeda with far more neutral language, and agreeing to let the entire issue lay until a later staff report. Author Philip Shenon will later write: “The staff suspected that Zelikow realized at the meeting that he had been caught in a clear-cut act of helping his friends in the Bush White House—that he had tried to twist the wording of the report to serve the needs of the Bush administration and its stumbling military campaign. Zelikow said later it was nothing of the sort.” Zelikow will deny allegations that he is a “White House mole,” and insist that all he wanted to do was help the commission keep “an open mind” on the subject. 9/11 Commission Executive Director Philip Zelikow rewrites a commission staff statement to imply there are ties between al-Qaeda and Iraq. Zelikow often rewrites many of the staff statements, but usually mainly to improve the style (see January 2004), and the addition of the Iraq-related material is unusual. The statement dealing with Iraq was originally compiled by international law expert Scott Allan, a member of the 9/11 Commission’s counterterrorism investigation, which is a strong focus of Zelikow’s attention. Allan writes the statement on the history of US diplomatic efforts to monitor and counteract al-Qaeda during the Clinton years, and the difficulties encountered by the government in working with “friendly” Arab nations such as Saudi Arabia to keep al-Qaeda at bay. Allan and other members of Team 3 are horrified at Zelikow’s rewrite of this report. Zelikow inserts sentences that allege direct ties between Iraq and al-Qaeda (see July 9, 2003), suggest that al-Qaeda officials were in systematic contact with Iraqi government officials in the years before 9/11, and even allege that Osama bin Laden had seriously considered moving to Iraq after the Clinton administration pressured the Taliban to oust him from Afghanistan (see April 4, 2000 and December 29, 2000). Zelikow’s additions are subtle and never directly state that Iraq and al-Qaeda had any sort of working relationship, but the import is clear. The effect of Zelikow’s rewrite would be to put the commission on record as strongly suggesting that such a connection between Iraq and al-Qaeda—long a White House argument to justify the war in Iraq—existed before 9/11, and therefore Iraq bore some of the responsibility for the attacks. Allan never made any such allegations in his original draft. Moreover, he knows from his colleagues who have pored over the archives at the CIA that no evidence of such a connection exists. Allan and the other Team 3 staffers confront Zelikow on the rewrite (see January 2004), and Zelikow eventually backs down (see January 2004). [Shenon, 2008, pp. 317-324]
The 9/11 Commission’s teams of investigators are asked to present interim staff reports to be read in the public hearings. Each report summarizes the staff’s findings regarding the subject of the day’s testimony. The reports help frame the questions for the day’s witnesses, and provide the basis for some of the chapters of the final report, so they are quite important and closely reported in the media. The commission’s executive director, Philip Zelikow, almost always rewrites the reports. Zelikow is smarting from the rounds of public criticism he has suffered for his apparent close ties to the Bush administration (see November 1997-August 1998, January 3, 2001, September 20, 2002, and March 21, 2004), and decides that he alone should read each staff report in the hearings—in essence, presenting himself as the public face of the commission and hopefully garnering some positive press coverage. That idea falls flat when angry staffers complain to the commissioners. But Zelikow continues to rewrite the reports, often improving on the language and wording, and sometimes rewriting reports to insert information that staffers find unsupportable (see January 2004). Mohamed ElBaradei, the president of the International Atomic Energy Agency (IAEA), meets with Secretary of State Colin Powell to ask a second time for the US’s participation in European-led negotiations with Iran over that nation’s nuclear program (see Fall 2003). Powell refuses. The IAEA and the Europeans—France, Germany, and Britain—believe that the US’s participation in the negotiations is essential to convince Iran to make real concessions. Iran wants assurances that the US will not attack it. Moreover, Iran knows that the Europeans will wait for US approval for any incentives they offer, such as membership in the World Trade Organization (WTO). During the negotiations, an Iranian diplomat tells British negotiator John Sawers not to keep pressing the Iranian delegation to give up its nuclear weapons development program: “Look, John, that’s what we are saving up for the Americans. We can’t spend all our possible concessions in negotiating with you. We’ll have nothing left.” As the Europeans continue to jockey with the balky Iranians, the US continues to stand apart—“leaving the driving to the EU,” as State Department neoconservative John Bolton will later comment. Only in 2005 will the Bush administration begin giving its grudging support to the negotiations, but it will continue to refuse to actually participate in them. [Scoblic, 2008, pp. 249-250]
The US Army announces that it is once again issuing what it calls “stop-loss” orders that will prevent thousands of soldiers from leaving the service once their tours of duty are up in Iraq, Afghanistan, and other active-duty deployments (see November 2002 and November 13, 2003). They will now be forced to remain until the end of their overseas deployments, and will remain available for further deployment for up to 90 days after they return home. The Army estimates that the new orders will affect about 7,000 soldiers. Colonel Elton Manske, chief of the Army’s Enlisted Division, explains, “This decision is really being driven by the readiness of units and the absolute intent to keep the units themselves intact down to as low as the squad and crew level, so we are assured of putting the best fighting force on the battlefield.” The commander of the Army’s Accessions Command, Lieutenant General Dennis Cavin, tells a CNN reporter that the stop-loss program is designed “to provide continuity and consistency” for deployed units and to enhance their ability “to execute their mission to the highest degree of their effectiveness.” The Army is also offering re-enlistment bonuses of up to $10,000 for soldiers deployed in Iraq, Afghanistan, and Kuwait. Military analyst Loren Thompson of the Lexington Institute says, “The use of stop-loss is often an indication of a shortfall of available personnel.” [American Forces Press Service, 1/2/2004; USA Today, 1/5/2004]
After 15 months of brutal torture in Morocco (see July 21, 2002 -- January 2004), British terror suspect Binyam Mohamed (see May-September, 2001) is flown to Afghanistan by the CIA.
Shock at Brutal Treatment - Even the hardened CIA agents in Afghanistan are shocked by the treatment meted out by the Moroccans, who, among other treatments, had repeatedly slashed and lacerated Mohamed’s genitals with scalpels and knives. Mohamed will later recall: “When I got to Kabul a female agent started taking close-up pictures of my genitals. She was shocked. When they removed my diaper she could see blood was still oozing from the cuts on my penis. For the first two weeks they had me on antibiotics and they took pictures of my genitals every day. They told me, ‘This is not for us. It’s for Washington.’ They wanted to be sure it was healing.”
'The Dark Prison' - But the initial shock gives way to a new session of brutality at the hands of his American captors. Mohamed will later call his Afghani detention facility “the dark prison,” and recall it as one of the lowest points of his life. In Morocco, Mohamed confessed to anything he was asked—being part of a plot to build a radioactive “dirty bomb,” being a confidant of 9/11 planner Khalid Shaikh Mohammed, having met Osama bin Laden dozens of times—in order to, he says, avoid further torture. Now the Americans want him to be a prosecution witness against high-ranking al-Qaeda already in US custody. But Mohammed knows nothing of these people or their crimes, he will later say. The tortures with scalpels are not repeated, but Mohamed will recall seemingly endless ordeals of being shackled by the wrists to his door frame, often in complete darkness, and in one memorable instance, being subjected to a rap CD being played in his cell at ear-shatteringly loud volumes for an entire month without stop. “It’s a miracle my brain is still intact,” he will later say. In September, he is transferred to Guantanamo (see September 2004 and After). [Daily Mail, 3/8/2009]
Hossein Khomeini, grandson of Grand Ayatollah Ruhollah Khomeini and a leading Iranian opposition figure, returns to Iran. During 2003, he spent several months in Iraq and visited the US, speaking at the neoconservative American Enterprise Institute (AEI) (see September 26, 2003). Khomeini’s return to Iran is a surprise to Michael Ledeen and the AEI. According to Ledeen, sources close to the Khomeini family suggest that he was lured back with a combination of threats and promises. Ledeen says that Khomeini’s wife was recently visited by Iranian security agents who told her, “If your children suddenly die in the streets, you must know that it was not our doing.” [New York Sun, 1/26/2004]
In response to a question at a news conference, Secretary of State Colin Powell says, “I have not seen a smoking gun, concrete evidence about the connection [between Saddam Hussein and al-Qaeda], but I think the possibility of such connections did exist and it was prudent to consider them at the time that we did.” [Associated Press, 1/8/2004; Independent, 1/11/2004] Former ambassador Joseph Wilson will later write, “The second justification for war—ties to ‘terrorism with a global reach,’ to use the president’s own words—had now been discredited by one of the most senior officials in his own administration.” [Wilson, 2004, pp. 413]
A male Iraqi dies while being interrogated by American officials, probably from the CIA. According to a report by the American Civil Liberties Union (see October 24, 2005), the male, detained in the city of Al Asad, is “standing, shackled to the top of a door frame with a gag in his mouth at the time he died.” The cause of death is asphyxia and blunt force injuries—in essence, being beaten to death while choking on a gag. The ACLU believes the Iraqi’s name was Abdul Jaleel. [American Civil Liberties Union, 10/24/2005]
A private delegation of US negotiators and arms experts flies to Pyongyang for a demonstration of North Korea’s nuclear weapons program (see October 4, 2002 and January 10, 2003 and After). They tour the Yongbyon nuclear reactor, and see actual plutonium. Siegfried Hecker, a former director of the Los Alamos nuclear lab and one of the delegates, comes back to Washington convinced that North Korea has indeed processed all of its fuel rods. In testimony before the Senate Foreign Relations Committee, he tells the senators that while he saw no sign of actual weapons, that does not mean they do not have weapons, just that he was shown no evidence of such weapons. David Kay quits his job as head of the Iraq Survey Group. [Los Angeles Times, 11/20/2005] He is being replaced by former senior UN weapons inspector Charles Duelfer, who recently said that the chances of Iraq being found to possess chemical or biological weapons is “close to nil.” Kay gives no reason for his resignation, but sources in Washington say he is resigning for both personal reasons and because of his disillusionment with the weapons search. Kay says he does not believe Iraq possesses any major stockpiles of chemical or biological weapons, and he does not believe it has had any such weapons since the 1991 Gulf War. “I don’t think they existed,” he says. “What everyone was talking about is stockpiles produced after the end of the last Gulf War and I don’t think there was a large-scale production program in the 90s. I think we have found probably 85 percent of what we’re going to find.” [BBC, 1/24/2004] He adds: “I think they gradually reduced stockpiles throughout the 1990s. Somewhere in the mid-1990s, the large chemical overhang of existing stockpiles was eliminated.” [New York Times, 1/25/2009] In 2005, Kay will say: “My view was that the best evidence that I had seen was Iraq indeed had weapons of mass destruction. It turns out we were all wrong, and that is most disturbing. If the intelligence community had said there were no weapons there, would the policymakers have decided for other reasons, regime change, human rights, whatever, to go to war? All you can say is we’ll never know, because in fact the system said, apparently, it’s a slam dunk, there are weapons there.” [CNN, 8/18/2005]
Misled by Internal Duplicity of Iraqi Scientists, Failure of Fundamental Intelligence Gathering and Analysis - Kay says that the CIA and other US intelligence agencies were misled by duplicitous Iraqi scientists, who, in the words of New York Times reporter James Risen, “had presented ambitious but fanciful weapons programs to [Saddam] Hussein and had then used the money for other purposes,” and by the agencies’ failure to realize that Iraq had essentially abandoned its WMD programs after the 1991 war; what remained of the Gulf War-era WMD stockpiles was destroyed by US and British air strikes in 1998 (see December 16-19, 1998). According to Kay, Iraqi scientists realized they could go directly to Hussein and present fantastic plans for weapons programs, and receive approval and large amounts of money. Whatever was left of an effective weapons capability was quickly turned into corrupt money-raising schemes by scientists skilled in the arts of lying and surviving in Hussein’s autocratic police state. “The whole thing shifted from directed programs to a corrupted process,” Kay says. “The regime was no longer in control; it was like a death spiral. Saddam was self-directing projects that were not vetted by anyone else. The scientists were able to fake programs.” Kay adds that in his view the errors committed by the intelligence agencies were so grave that he recommends those agencies revamp their intelligence collection and analysis efforts. Analysts have come to him, he says, “almost in tears, saying they felt so badly that we weren’t finding what they had thought we were going to find—I have had analysts apologizing for reaching the conclusions that they did.” The biggest problem US agencies had, Kay says, was their near-total lack of human intelligence sources in Iraq since the UN weapons inspectors were withdrawn in 1998. 'Rudimentary' Nuclear Weapons Program - Iraq did try to restart its moribund nuclear weapons program in 2000 and 2001, Kay says, but that plan never got beyond the earliest stages. He calls it “rudimentary at best,” and says it would have taken years to get underway. “There was a restart of the nuclear program,” he notes. “But the surprising thing is that if you compare it to what we now know about Iran and Libya, the Iraqi program was never as advanced.”
No Evidence of Attempt to Purchase Nigerien Uranium - Kay says that his team found no evidence that Iraq ever tried to obtain enriched uranium from Niger, as has frequently been alleged (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003). “We found nothing on Niger,” he says. Democrats: Proof that Administration 'Exaggerated ... Threat' - Senator John Rockefeller (D-WV), the ranking member of the Senate Intelligence Committee, says of Kay’s resignation: “It increasingly appears that our intelligence was wrong about Iraq’s weapons, and the administration compounded that mistake by exaggerating the nuclear threat and Iraq’s ties to al-Qaeda. As a result, the United States is paying a very heavy price.” Rockefeller’s counterpart in the House of Representatives, Jane Harman (D-CA), says Kay’s comments indicate a massive intelligence failure and cannot be ignored. Asked to Delay Resignation until after State of Union Address - In 2005, Kay will reveal that he was asked by CIA Director George Tenet to hold off on his resignation. According to Kay, Tenet told him: “If you resign now, it will appear that we don’t know what we’re doing. That the wheels are coming off.” Kay will say, “I was asked to not go public with my resignation until after the president’s State of the Union address which—this is Washington and in general—I’ve been around long enough so I know in January you don’t try to get bad news out before the president gives his State of the Union address.” Kay does not say exactly when Tenet asked him to delay his resignation. Pentagon adviser Richard N. Perle speaks at a charity event whose stated purpose is to express “solidarity with Iran” and raise money for Iran earthquake victims. During the event, statements are made in support of “regime change in Iran.” The event is attended by FBI agents because of suspicions that the event has connections to the Mujahedeen-e Khalq (MEK), a militant Iranian opposition group that is included on the state department’s list terrorist organizations. The US Treasury Department will freeze the assets of the event’s prime organizer, the Iranian-American Community of Northern Virginia, two days later (see January 26, 2004). Perle tells the Washington Post that he was unaware of possible connections to MEK. [Washington Post, 1/29/2004]
The FBI’s on-scene commander in Baghdad sends an e-mail to senior FBI officials at FBI headquarters in Washington, discussing the allegations of abuse at Abu Ghraib prison. The e-mail advises the senior officials not to investigate the allegations. “We need to maintain good will and relations with those operating the prison,” it reads. “Our involvement in the investigation of the alleged abuse might harm our liaison.” [American Civil Liberties Union, 2/23/2006]
The US Treasury Department freezes the assets of the Iranian-American Community of Northern Virginia after the organization holds a fundraising event (see January 24, 2004), the stated purpose of which was to provide support to Iranian earthquake victims. The FBI believes that some of the money raised was also meant to fund the Mujahedeen-e Khalq (MEK), a US-designated terrorist organization whose mission is to overthrow the government of Iran. The CIA’s inspector general conducts an internal investigation of the treatment of CIA detainees in Afghanistan. As part of that investigation, the use of drugs on detainees is raised. When the inspector interviews the commanding officer of a secret detention facility in eastern Afghanistan shared by US military and intelligence teams, the inspector asks if the “OGA”—an acronym standing for “other government agency” and used to refer to the CIA—had been able to “practice their TTP [tactics, techniques and procedures] at your facility.” The commander replies, “No, they can’t use drugs or prolonged sensory deprivation in our facility.” It is unclear whether the commander is referring to interrogations. A senior US official will say in 2008 that the commander’s mention of drugs was either a mistake or a reference to am agency other than the CIA. [Washington Post, 4/22/2008]
An Army dog handler at Abu Ghraib tells military investigators that, as per the directive from Defense Secretary Rumsfeld (see December 2, 2002), “[S]omeone from [military intelligence] gave me a list of cells, for me to go see, and pretty much have my dog bark at them.… Having the dogs bark at detainees was psychologically breaking them down for interrogation purposes.” Using attack dogs to threaten or harm prisoners is a violation of the Geneva Conventions. During a visit to Russia, US Undersecretary of State for Arms Control John Bolton tells the Russian daily Kyodo News that Iran is pursuing a secret nuclear weapons development program unbeknownst to the International Atomic Energy Agency (IAEA). [Antiatom News, 2/3/2004]
