President Franklin D. Roosevelt signs Executive Order 8248, reorganizing the Executive Office of the President. According to the order, “There shall be within the Executive Office of the President the following principal divisions, namely: (1) The White House Office, (2) the Bureau of the Budget, (3) the National Resources Planning Board, (4) the Liaison Office for Personnel Management, (5) the Office of Government Reports, and (6) in the event of a national emergency, or threat of a national emergency, such office for emergency management as the President shall determine.” The order creates the Office of Emergency Management (OEM), a civil defense unit responsible for protecting government functions in the event of a disaster. The President’s Secretary declares that in times of national emergency, “it has always been necessary to establish administrative machinery in addition to that required for normal work of the government.… Although these management facilities need be brought into action only when an emergency or serious threat of emergency exists, they must function in an integral relationship to the regular management arms of the President.” [Executive Order 8248, 9/8/1939; New York Times, 9/10/1939; New York Times, 3/28/1941; New York Times, 4/20/1941]
The FBI maintains a list of individuals that are to be closely monitored and/or detained in the event of a national emergency or war. The index of names, known officially as the “Custodial Detention Program,” is spawned from a list established in 1939 by FBI Director J. Edgar Hoover (see November 1939). The updated list is composed of persons thought to have a “Communistic, Fascist, Nazi, or other nationalistic background.” The list includes individuals that distribute “literature and propaganda favorable to a foreign power and opposed to the American way of life,” as well as “agitators who are adherents of foreign ideologies.” The names on the list are divided into two categories: those who are to be immediately detained in the event of war and those who are to be subject to close surveillance in the event of war. The program will be criticized for being unreliable and potentially illegal (see 1943). Attorney General Francis Biddle abolishes the FBI’s Custodial Detention Program, which is designed to round up suspected dissidents in times of national emergency or war (see November 1940-1943). However, FBI Director J. Edgar Hoover secretly re-establishes the list under a new name: the Security Index (see Early 1943-1971). Biddle clearly informs the FBI: “There is no statutory authorization or other present justification for keeping a ‘custodial detention’ list of citizens.… [I]t is now clear to me that this classification system is inherently unreliable.” The attorney general comments: “The evidence used for the purpose of making the classifications was inadequate; the standards applied to the evidence for the purpose of making the classifications were defective; and finally, the notion that it is possible to make a valid determination as to how dangerous a person is in the abstract and without reference to time, environment, and other relevant circumstances, is impractical, unwise, and dangerous.” But Hoover does not comply with the attorney general’s order. He instead changes the name of the list from the Custodial Detention Program to the Security Index. The Senate Select Committee on Intelligence will later report, “The attorney general and the Justice Department were apparently not informed of the FBI’s decision to continue the program.” FBI headquarters informs its field offices, “The fact that the Security Index and Security Index Cards are prepared and maintained should be considered strictly confidential, and should at no time be mentioned or alluded to in investigative reports, or discussed with agencies or individuals outside the bureau other than duly qualified representatives of the Office of Naval Intelligence and the Military Intelligence Division, and then only on a strictly confidential basis.” [Senate Select Committee to Study Governmental Operations with Respect to Intelligence Activities, 5/1976, pp. 420-421]
The FBI maintains a “Security Index” of US citizens that are to be targeted for surveillance and/or detention in the event of a national emergency or war. The list is carried over from the FBI’s Custodial Detention Program, which was abolished by the attorney general in 1943 (see 1943 and November 1940-1943). A government source tells the New York Times that the purpose of the Security Index is to “assist in rounding up people who might commit sabotage or espionage” in the event of a disaster. The index is at first composed mostly of suspected communists, but is later expanded to include a wide range of political groups. By the 1960s, names on the list include professors, teachers, labor union organizers, authors, journalists, doctors, scientists, and clergymen. The names on the Security Index are broken down into three categories: leaders of “subversive” groups, supporters of such groups, and supporters of such groups considered to be violent. At its peak in the late 1960s, the FBI’s Security Index reportedly lists more than 26,000 citizens. FBI Special Agent M. Wesley Swearingen will later say the number is actually much higher, claiming 50,000 people are on the list in Chicago alone. Sources will later tell the New York Times that the list includes several people who pose “no genuine internal security threat.” The list is utilized by the FBI’s secret COINTELPRO program, which is used to discredit anti-war and other “New Left” groups. The Security Index will be transferred to the Administrative Index within the FBI in late 1971 (see Late 1971). President Harry Truman signs the National Security Act of 1947, reorganizing the military and overhauling the government’s foreign policy-making bureaucracy. The act gives birth to three major organizations: the Department of Defense (DOD), the Central Intelligence Agency (CIA) and the National Security Council (NSC). The DOD unifies the three branches of the military—the Army, Navy and Air Force—into a single department overseen by a secretary of defense. The act establishes a separate agency, the CIA, to oversee all overt and covert intelligence operations. The act forms the NSC to directly advise the President on all matters of defense and foreign policy. In addition, the act establishes the National Security Resources Board (NSRB) to advise the President “concerning the coordination of military, industrial, and civilian mobilization” in times of war. Should the nation come under attack, the NSRB will be in charge of allocating essential resources and overseeing “the strategic relocation of industries, services, government, and economic activities, the continuous operation of which is essential to the Nation’s security.” [US Congress. The National Security Resources Board (NSRB) adopts a national censorship plan designed to restrict the free flow of information to the public in the event of a national emergency or war. The government assumes the power to censor communications and suspend freedoms of the press. An NSRB document outlining the program says censorship may be activated in a “time of war or of national emergency proclaimed by the president and found by him to arise from the use or threat of force by a foreign power.” The new NSRB plan is an extension of a program established during World War II. Author Ted Galen Carpenter will later comment: “Although advocates of censorship habitually insisted that it would only by invoked during wartime, the guidelines contained no such limitation. A declaration of war was not required; merely a declaration of emergency arising from a perceived foreign menace.” [Carpenter, 1995, pp. 112-113]
With the approval of President Harry S. Truman, the US government constructs a massive 200,000-square-foot underground facility along the Maryland-Pennsylvania border, about seven miles north of Camp David and about 65 miles north of Washington, DC. Site-R at Raven Rock, officially known as the Alternate Joint Communications Center, is one of 96 bunkers being assembled around the nation’s capital in preparation for a potential nuclear conflict with the Soviet Union (see 1950-1962). Site-R is designed to serve as a complete backup to the Pentagon in times of war and is complete with state-of-the-art technology, alternate command posts, war rooms, and living spaces for top officials. The subterranean fortress resembles a small city, with all the basic necessities for sustaining a population in the thousands for months at a time. The site is equipped with its own self-generating power supply, offices, medical clinic, fire department, mail service center, dining halls, and dormitories. The facility is said to have its own a chapel, two fishing lakes, a barbershop, a drug store, and even a bowling alley. There are also rumors that an underground tunnel connects Site-R to Camp David less than 10 miles to the south. Decades later, Vice President Dick Cheney and other high-ranking officials will relocate to Site-R in the aftermath of the terrorist attacks of September 11, 2001 (see (11:00 a.m.) September 11, 2001 and September 12, 2001-2002). Fears of a nuclear conflict with the Soviet Union inspire the US government to construct a network of 96 nuclear-resistant fallout shelters around Washington, DC. The underground “Federal Relocation Centers,” collectively known as the “Federal Relocation Arc,” are designed to serve as both living quarters and command bunkers for a post-nuclear government. The underground installations will later be described as the “backbone” of the ultra-secretive Continuity of Government (COG) program, which is meant to keep the government functioning in times of national emergency. Under Presidents Harry S. Truman and Dwight D. Eisenhower, the US government spends billions of dollars carving out caves and assembling the underground fortresses in preparation for nuclear war. Upon completion, the bunkers are said to resemble small cities, each capable of sustaining a population in the thousands for months at a time. Each facility is equipped with its own self-generating power supply, fresh water source, living quarters, food rations, command posts, telecommunications equipment, and other requirements for housing officials and running the federal government from deep underground. In the event of a crisis, high-ranking officials, most notably the president and those in the presidential chain of command, are to be secretly whisked away to the underground installations in order to ensure the continuation of government functions. Some of the known underground locations include Mount Weather, fortified within the Blue Ridge Mountains about 50 miles west of Washington, DC (see 1952-1958); Site R, along the Maryland-Pennsylvania border near Camp David (see 1950-1954); and the Greenbrier, underneath a hotel resort in White Sulphur Springs, West Virginia (see 1959-1962). President Harry S. Truman signs Executive Order 10186, shifting many responsibilities of the National Security Resources Board (NSRB), which oversees federal emergency planning, to a new civil defense organization, the Federal Civil Defense Administration (FCDA). The FCDA is placed within the Office of Emergency Management (OEM), an agency established as part of the Executive Office of the President years earlier by President Franklin Roosevelt (see September 8, 1939). The purpose of the FCDA, according to President’s Truman’s order, “shall be to promote and facilitate the civil defense of the United States in cooperation with several States.” [Executive Order 10186, 12/1/1950] The Federal Civil Defense Act of 1950 will be signed into law weeks later, establishing the FCDA as an independent agency and detailing the organization’s responsibilities (see January 12, 1951)
President Harry S. Truman signs Executive Order 10193, establishing the Office of Defense Mobilization (ODM) within the Executive Office of the President. The ODM is granted a wide range of emergency powers in order to mobilize civilians, industries and government agencies to defend the country during a crisis. As part of a broad “mobilization” effort, President Truman calls for increasing the number of total armed forces, increasing defense spending, and expanding the economy to increase war production. President Truman declares a national emergency and delegates many of his war powers to the head of the ODM. According to the New York Times, “President Truman proclaimed a state of emergency this morning and delegated many of his own war powers to Charles E. Wilson, the new mobilization director.” Citing the threat of “Communist imperialism,” President Truman “signed the proclamation of emergency, which unleashed scores of additional executive powers, and issued an executive order granting virtually blanket authority to Mr. Wilson to carry out all aspects of war production and economic control he deemed necessary.” According to the order, the mobilization director “shall on behalf of the president direct, control, and coordinate all mobilization activities of the executive branch of the government, including but not limited to production, procurement, manpower, stabilization, and transport activities.” [Executive Order 10193, 12/16/1950; New York Times, 12/16/1950, pp. 1; New York Times, 12/16/1950, pp. 1]
President Harry S. Truman signs the Federal Civil Defense Act of 1950. The Federal Civil Defense Administration (FCDA), established weeks earlier within the Executive Office of the President (see December 1, 1950), is transformed into an independent agency headed by a presidential appointee. The FCDA is placed in charge of providing emergency aid and assistance to local communities affected by disasters. The act also provides special emergency powers to the FCDA and the President in the event of a national crisis. According to President Truman, the act establishes a “basic framework for preparations to minimize the effects of an attack on our civilian population, and to deal with the immediate emergency conditions which such an attack would create.” According to the New York Times, “The measure directs the Federal Government to provide leadership to states and communities in developing arrangements to protect civilian life and property in the country’s 150 critical target areas against possible enemy attack by atomic bombs, biological or bacteriological warfare or any other technique.” The new civil defense plans are estimated to cost $3.1 billion. The FCDA will distribute brochures and produce television and radio segments aimed at preparing the general public for a nuclear attack. The FCDA will also stage drills and exercises to test public and government readiness for such a disaster. The agency will become infamous for encouraging civilians to “duck and cover” in the event of a nuclear strike. J. Edgar Hoover, director of the Federal Bureau of Investigation (FBI), tells the House Appropriations Committee that the FBI is prepared to arrest 14,000 purported communists inside the US in the event of war with Russia. James M. McInerney, assistant attorney general, refuses to provide the committee with details regarding those on the list, but says they are “either out-and-out Communists” or are “sympathetic toward the Communist cause.” The officials are apparently referring to the FBI’s Security Index, which was established in 1943 (see 1943 and Early 1943-1971). A roughly 200,000-square-foot facility known as Mount Weather, codenamed “Operation High Point,” is constructed deep within an isolated strip of the Blue Ridge Mountains, approximately 50 miles west of Washington, DC. The installation, finished in 1958 at the cost of more than $1 billion, will serve as the flagship of a secret network of nuclear resistant shelters currently being constructed around the nation’s capital (see 1950-1962). Mount Weather is designed to be the headquarters of a post-nuclear government in the event of a full-scale war with the Soviet Union. Construction of the facility is authorized under the highly classified Continuity of Government program, meant to ensure the survival of the federal government in times of extreme emergency. The enormous complex resembles a miniature city, capable of supporting a population in the thousands for months at a time. Mount Weather is equipped with its own streets and sidewalks, dormitories, offices, a hospital, television and radio studios, reservoirs of drinking and cooling water, dining halls, stockpiles of food, a power plant, a sewage treatment plant, a crematorium, government and military command posts—everything needed to sustain and run an underground government during and after a nuclear war. A parallel executive branch will be stationed at Mount Weather to take over the functions of the federal government in the event of a disaster (see March 1976). In the 1960s and 1970s Mount Weather will develop a “Civil Crisis Management” program, designed to monitor and manage potential resource shortages, labor strikes, and political uprisings (see 1967-1976). Mount Weather will be accused in the 1970s of spying on US citizens (see September 9, 1975). In December 1974, a passenger airliner will crash into the mountainside, drawing public attention to the secret installation for the first time (see 11:10 a.m. December 1, 1974). The plans will be designed to ensure the continuation of essential government functions in the event of a major disaster, such as a nuclear attack on Washington DC. According to the order, “each Federal department and agency shall prepare plans for maintaining the continuity of its essential functions at the seat of government and elsewhere during the existence of a civil-defense emergency.” In addition to the FCDA, the National Security Resources Board (NSRB), established by the National Security of Act of 1947, (See July 26, 1947), is to play an advisory role in the emergency plans. The US Supreme Court rules that the federal government cannot seize the nation’s steel mills. In April, President Truman, fearing a nationwide strike that could impact the US war effort in Korea, ordered the seizure of all US steel mills; the lawsuit that resulted, Youngstown Sheet & Tube Co. v. Sawyer, quickly made its way to the Supreme Court.
Rejection of 'Inherent Powers' Claim - During oral arguments, the justices grilled Acting Attorney General Philip Perlman, demanding to know what statutes he had relied on for his arguments and asserting that the president had limitations both on his emergency wartime powers and on his ability to claim that he is the “sole judge” of the existence of, and remedies for, an emergency. The justices are not convinced by the government’s arguments for the president’s “inherent powers.” They are also troubled by repeated refusals of the government to provide facts and documentary backing for its legal arguments, and its reliance instead on claims of “national security.” The attorney for the steel industry, John Davis, quoted Thomas Jefferson in his argument: “In questions of power, let no more be said of confidence in man, but bind him down from mischief by the chains of the Constitution.” Justice William O. Douglas noted that if the government’s claims were valid, there would be “no more need for Congress.”
Court Rejects Argument - In a 6-3 vote, the Court rules that the president has no inherent power to seize the steel mills. Writing for the majority, Justice Hugo Black states: “In the framework of our Constitution, the president’s power to see that the laws are faithfully executed refutes the idea that he is to be a lawmaker.… The founders of this nation entrusted the lawmaking power to the Congress alone in both good and bad times.… This is a job for the nation’s lawmakers.” In a concurring opinion, Justice Robert Jackson writes, “No penance would ever expiate the sin against free government of holding that a president can escape control of executive powers by law through assuming his military role.” In his dissent, Chief Justice Fred Vinson (see March 1952) argues that “the gravity of the emergency” overrides the Constitutional arguments accepted by the majority of the Court. “Those who suggest that this is a case involving extraordinary powers should be mindful that these are extraordinary times. A world not yet recovered from the devastation of World War II has been forced to face the threat of another and more terrifying global conflict.” [Savage, 2007, pp. 123; Siegel, 2008, pp. 163-164] In 2007, reporter and author Charlie Savage will observe that the Youngstown decision “turned out to be only a pause in the movement toward an increasingly authoritarian presidency.” [Savage, 2007, pp. 19]
Reorganization Plan No. 3 of 1953 is signed into law, restructuring the Office of Defense Mobilization (ODM) within the Executive Office of the President. The ODM, originally created by President Harry S. Truman in December of 1950 (see December 16, 1950), will incorporate the responsibilities of the National Security Resources Board (NSRB), which shares similar objectives. The purpose of the ODM is to ensure the continuation of essential government and industry functions, particularly during times of crisis. President Dwight D. Eisenhower says merging the ODM and the NSRB will “enable one Executive Office agency to exercise strong leadership in our national mobilization effort, including both current defense activities and readiness for any future national emergency.” [New York Times, 4/3/1953, pp. 1; US Congress. President Dwight D. Eisenhower appoints CBS executive Theodore F. Koop, who served as deputy director of the Office of Censorship during World War II, to head a new, secret, 26-member emergency censorship board. The group is placed in charge of developing plans to restrict the free flow of information to the public in the event of a national emergency or war. The plans were first adopted in 1949 (see 1949). Approximately 40 “civilian executives” agree to work for the standby censorship unit should a crisis lead to its activation. Reorganization Plan No. 1 of 1958 is signed into law, merging the Federal Civil Defense Administration (FCDA) and the Office of Defense Mobilization (ODM) into a single agency, the Office of Civil and Defense Mobilization (OCDM). The OCDM will be responsible for ensuring the continuation of essential government and industry functions in the event of a national emergency. President Dwight D. Eisenhower submitted the reorganization plan to Congress in April 1958 with the intention of establishing a “single pattern with respect to the vesting of defense mobilization and civil defense functions.” In addition to merging the civil defense agencies, the reorganization plan transfers to the president the authorities previously delegated to the FCDA and the ODM (see December 1, 1950 and December 16, 1950). The Federal Civil Defense Act of 1950 is amended, redefining the role played by the federal government in civil defense plans. Prior to the amendment, civil defense was primarily the responsibility of state and local authorities. The amendment, according to the New York Times, “sets forth a broadened program of Federal responsibility in support of local defense efforts.” The plan places the federal government in charge of providing “direction, coordination, guidance, and assistance to the states in administering and financing their civil defense effort.” Although programs set forth in the amendment will not be funded for several years, the legislation will eventually lead to the creation of a nationwide civil defense cadre. As a result, civil defense offices are established in counties, towns, cities, and states across the country. [New York Times, 11/9/1958, pp. 1; B. Wayne Blanchard, 2/5/2008, pp. 11, 12]
From 1959 to 1962, beneath a hotel resort known as the Greenbrier in White Sulphur Springs, West Virginia, the government secretly constructs an installation to shelter leaders of Congress in times of national emergency. The massive facility is equipped with diesel generators, food stocks, drinking water, living spaces, luxury rooms, dining halls, state-of-the-art computers and telecommunications equipment, a television studio, and an incinerator. The shelter contains chambers for the House and Senate, as well as a larger room for joint sessions. The bunker is just one of nearly 100 shelters being constructed for government officials in preparation for a potential nuclear conflict with the Soviet Union (see 1950-1962). The facility would not be able to sustain a direct nuclear strike, but could shelter VIPs from radioactive fallout. The relocation center is operated by Forsythe Associates, which will later be described by the Washington Post as an “obscure company ostensibly based in Arlington.” Although designed for Congress, few members of the House and Senate will ever be told of the shelter’s existence. The Washington Post will later note: “Just how Congress was expected to reach the Greenbrier is unclear. It is at least a five-hour drive from the Capitol… an hour’s flight from Washington. And because very few members of Congress have been aware that the facility exists, it would take far longer than that to round them up.” [Washington Post, 5/31/1992] A report published by the Washington Post in May 1992 will expose the site to the public and lead to its official decommissioning in 1995 (see May 31, 1992-July 31, 1995).
President John F. Kennedy signs Executive Order 10952, calling for a nationwide fallout shelter program. According to the New York Times, “President Kennedy today put the Pentagon in charge of a greatly increased [shelter] program to protect American civilians against the effects of nuclear attack.” The New York Times reports the program will “concentrate on public and quasi-public buildings—factories, office buildings, churches—where basements and other protected areas could be easily made into shelters for large numbers of persons.” The fallout shelters are expected to cost approximately $300 million. The plan is largely the creation of Frank B. Ellis, the new director of the Office of Civil and Defense Mobilization (OCDM). The White House reorganizes civil defense responsibilities within the federal government. The OCDM is renamed the Office of Emergency Planning (OEP) and several of the organization’s responsibilities are shifted to the Office of Civil Defense (OCD), a new organization established within the Department of Defense. Mount Weather, a secret underground government installation located about 50 miles west of Washington, DC (see 1950-1962), maintains a “Civil Crisis Management” program aimed at monitoring and managing civil emergencies, such as resource shortages, labor strikes, and political uprisings. The installation is a key component of the highly classified Continuity of Government (COG) program, which is meant to ensure the survival of the federal government in times of national emergency. “We try to monitor situations and get them before they become emergencies,” says Daniel J. Cronin, assistant director of the Federal Preparedness Agency (FPA), which is responsible for managing parts of the facility and program. As part of the program, Mount Weather collects and stores data regarding military and government installations, communications, transportation, energy and power, food supplies, manufacturing, wholesale and retail services, manpower, medical and educational institutions, sanitary facilities, population, and stockpiles of essential resources. The Progressive reports in 1976, “At the heart of the Civil Crisis Management program are two complicated computer systems called the ‘Contingency Impact Analysis System’ (CIAS) and the ‘Resource Interruption Monitoring System’ (RIMS).” The complex systems apparently interpret crisis situations, predict future outcomes, and provide possible solutions for emergencies. According to a 1974 FPA report obtained by The Progressive, CIAS and RIMS are used in close cooperation with private US companies “to develop a range of standby options, alternative programs… to control the economy in a crisis situation.” The Civil Crisis Management program is put on standby during several national anti-war demonstrations and inner city riots in 1967 and 1968. The program is activated during a 1973 Penn Railroad strike and is put to use again in 1974 when a strike by independent truckers threatens food and fuel shipments. By March 1976, the Civil Crisis Management program is being used on a daily basis to monitor potential emergencies. Senator John Tunney (D-CA) will claim in 1975 that Mount Weather has collected and stored data on at least 100,000 US citizens (see September 9, 1975). [Progressive, 3/1976]
In the wake of anti-war demonstrations and urban rioting in several US cities, the Pentagon establishes a set of civil disturbance plans designed to put down political protests and civil unrest. Conducted under the codename Operation Garden Plot, the new program significantly increases the role of the military in training for and intervening in social uprisings. The Pentagon develops contingency plans for every city considered to have potential for uprisings by students, minorities, or labor unions. Each area of the country follows a subplan of Operation Garden Plot. Operation Cable Splicer, for instance, covers the states of California, Oregon, Washington, and Arizona (see May 1968, February 10, 1969, March 1969, and May 1970). Each region will conduct exercises and war games to practice and develop its individual plans. To oversee the operations, the Pentagon establishes the Directorate of Civil Disturbance and Planning Operations. The government establishes the Directorate of Civil Disturbance and Planning Operations within the Department of Defense. The directorate will oversee civil disturbance operations, such as Garden Plot and Cable Splicer (see Winter 1967-1968), and conduct surveillance on US citizens in search of possible security threats. The directorate is headquartered in the basement of the Pentagon in what will become known as the “domestic war room.” The center utilizes a massive computer system to monitor “all public outbursts and political dissent” within the United States. New Times magazine will describe the war room as follows: “Surrounded by acetate map overlays, a fulltime staff of 180, including around-the-clock ‘watch teams,’ [uses] teletype machines, telephones, and radios to keep in constant communication with every National Guard headquarters and all major military installations in the continental United States.” Seven Army infantry brigades totaling 21,000 troops are at the directorate’s disposal. Military and law enforcement officials gather at the California National Guard’s training center for a workshop seminar on civil disturbance control. The program, known as Cable Splicer I, is designed to prepare officials for a future exercise, Cable Splicer II, which will be conducted in March 1969 (see February 10, 1969 and March 1969). Operation Cable Splicer is a subplan of Operation Garden Plot, a national program established by the Pentagon to quash political uprisings and social unrest (see Winter 1967-1968). The subplan is designed to cover the states of California, Washington, Oregon, and Arizona. [New Times, 11/28/1975]
The Office of Emergency Planning, which is responsible for parts of the federal government’s civil defense and continuity of government plans, is renamed the Office of Emergency Preparedness (OEP). Federal agencies responsible for emergency planning have undergone several duty and title changes over the past two decades (see December 1, 1950, December 16, 1950, June 12, 1953, July 1, 1958, and July 20, 1961). The changes, the New York Times notes, have created a “tale of more names than even government civil servants care to remember.” The latest change is largely superficial and comes as the result of Public Law 90-608, which was drafted and presented to Congress by President Johnson. California Governor Ronald Reagan, along with a variety of other local, state, and federal officials, kicks off a regional exercise known as Cable Splicer II at the Governor’s Orientation Conference. Operation Cable Splicer is part of Operation Garden Plot, a program established by the Pentagon to monitor and put down civil unrest (see Winter 1967-1968). Cable Splicer is a subplan designed to cover the states of California, Washington, Oregon, and Arizona. Governor Reagan addresses an audience of approximately 500 Army officials and troops, local and state police officers, military intelligence personnel, private executives, and state legislators. “You know,” he says, “there are people in the state who, if they could see this gathering right now and my presence here, would decide that their worst fears and convictions had been realized—I was planning a military takeover.” According to New Times magazine, Chief Deputy Attorney General Charles O’Brien speaks bluntly about constitutional rights, “arguing at one point that if the Constitution prevents the police from gathering political intelligence, then the Constitution goes too far.” O’Brien continues: “This is a revolution, and anything goes. A civil disturbance anywhere in this state is an attack on the state itself.” Deputy Attorney General Buck Compton argues that “free speech, civil rights, [and] rights to assembly” have all become “clichés.” Congressman Clair Burgener attends the conference, but is only vaguely aware of the scope of the upcoming exercise and emergency plans. He is later surprised to learn of the conference’s true nature. He will later tell New Times magazine, “If this was going on in this spirit, they were certainly pulling the wool over the eyes of the invited guests.” After reviewing the plans, he will say: “Well, I’ll be damned! This is what I call subversive.” The Cable Splicer II exercise will be conducted a month later (see March 1969). [New Times, 11/28/1975]
A large exercise, codenamed Cable Splicer II, is conducted in California to test and develop the ability of local, state, and federal officials to deal with political protests and urban rioting. Operation Cable Splicer is a regional subplan of the Pentagon’s Operation Garden Plot (see Winter 1967-1968). A month earlier, Governor Ronald Reagan and other officials ceremoniously kicked off the war game (see February 10, 1969). The exercise, which simulates a variety of civil disturbances, is spread across 23 political jurisdictions and includes National Guard officers, Army advisers, senior police and sheriff officers, and private executives. According to New Times magazine, “over 1,200 preplanned intelligence reports on supposedly imaginary events, people, and organizations” are pasted on index cards and handed to the participants to help “generate the make-believe war.” The magazine will later report: “The players listen to a special intelligence summary, learning the background of the civil disturbance that has led to the current ‘emergency.’ At that point, the ‘controllers’—usually senior National Guard officers and their Army advisers—begin play, feeding the IBM-card preplanned intelligence reports of dissident activity to the players. Seated at rows of desks dotted with telephones, facing a ‘situation map’ of their community, the players respond to the unfolding scenario.”
Storyline - In the first phase of the exercise, an arrest and shooting “provoke crowd unrest and threats against public officials.” Fourteen simulated hours later, rioters attack a police car and injure an officer. A member of a minority group is killed and two others are wounded. There are threats of retaliation against police officers. Mock intelligence reports suggest widespread rioting is likely, as dozens of apparent radicals are flown in on a “chartered flight” and picked up at the airport by 20 separate vehicles. The second phase of the exercise begins with “the ambush of several police cars, the attempted assassination of the mayor, the bombing of local armories, the destruction of vehicles and ammunition stocks, and the gathering of thousands of people in the streets.” The exercise participants call in police from outside jurisdictions and cities, but they are unsuccessful at quelling the violence. In the third phase of the exercise, according to New Times, “intelligence reports pouring into the Emergency Operations Center disclose more fire bombings, attempted assassinations of public officials, hoarding of water in certain areas, and sniping of fire trucks. The streets remain filled with thousands of people, and the National Guard is called to active duty.” As the crowd turns increasingly violent, the Army is called upon to take over for the National Guard. The crowd is finally dispersed, although the details of exactly how are unknown. “At their disposal,” New Times reports, “there are heavy artillery, armor, chemical and psychological warfare teams, and tactical air support.” The third phase concludes with a few “loose militants” unable to gain popular influence. President Nixon signs Executive Order 11490, updating the nation’s secretive Continuity of Government (COG) plans. Under the vague title, “Assigning Emergency Preparedness Functions to Federal Departments and Agencies,” the order directs government leaders to ensure the continuation of “essential functions” in the event of a crisis. The order grants a wide range of emergency powers to the executive branch. It directs department heads to have emergency plans for succession of office, predelegation of authority, safekeeping of records, alternative command facilities, and other “emergency action steps.” The plans are to be overseen by the Office of Emergency Preparedness (OEP). Conservative writer Howard J. Ruff will express concern over the scope of the order. “The only thing standing between us and a dictatorship,” Ruff writes, “is the good character of the president and the lack of a crisis severe enough that the public would stand still for it.” In 1984, Attorney General William Smith will object to attempts by the Reagan administration to expand the powers granted in the order (see August 2, 1984). President Reagan will officially update the plans in 1988, replacing and expanding Executive Order 11490 with Executive Order 12656 (see November 18, 1988). Louis O. Giuffrida, a colonel in the US Army who will later head the Federal Emergency Management Agency (FEMA) under President Reagan (see May 18, 1981), writes a paper while at the US Army War College advocating martial law in the event of a militant uprising by African Americans. The Miami Herald will later report that Giuffrida’s paper calls for the roundup and transfer of at least 21 million “American Negroes” to “assembly centers or relocation camps” in the event of an emergency or uprising by black citizens. The paper will resemble martial law plans later drafted by FEMA while Giuffrida is the agency’s director (see June 30, 1982). [Miami Herald, 7/5/1987]
Participants in a California civil disturbance exercise, codenamed Cable Splicer III, hold an “After Action Conference” to discuss the results. The exercise was designed to pracitce Operation Cable Splicer, a regional subplan of the Pentagon’s Operation Garden Plot (see Winter 1967-1968). The participants, which include Army officials, local police officers, and private executives, spend much of the conference pronouncing their disgust for leftists and other activists. According to New Times magazine, speakers at the conference condemn “university administrators who demur at giving the police free rein on the campuses; parents of ‘would-be revolutionaries’ who support their children; and legislators who investigate police actions.” Political demonstrators are referred to as “guerrillas,” “modern day barbarians,” “Brown Shirts,” “kooks,” and “VC.” Los Angeles Police Department Inspector John A. McAllister gives a lecture listing activities that “require police action,” including “loud, boisterous, or obscene” behavior on beaches, “love-in type gatherings in parks where in large numbers they freak out,” disruptions by “noisy and sometimes violent dissidents,” peace marches and rock festivals where “violence is commonplace and sex is unrestrained,” and “campus disruptions—which in fact are nothing more than mini-revolutions.” [New Times, 11/28/1975]
Press reports and freedom of information advocates expose details regarding the government’s secret plans to censor public information in the event of a national emergency or war. In the event of a declared emergency, the Office of Censorship, led by a 26-member board of “executive reservists,” would be in charge of restricting virtually all public information. The unit was established in 1949 as a reincarnation of a censorship office created during World War II (see 1949). The board was apparently put in place to oversee the unit in 1958 (see 1958). The unit is currently being operated out of the Office of Emergency Preparedness. In an article published in the Prescott Courier, Sam Archibald, director of the Freedom of Information Center, writes, “The government has set up a ‘Stand-by Voluntary Censorship Code’ and has planned all the bureaucratic trappings necessary to enforce the code.” Archibald says the plan would “become effective either in wartime or in some undefined ‘national emergency.’” The plans, he writes, are ready to be applied in “all kinds of less than war situations.” In the event of a crisis, members of the standby censorship office would be dispatched throughout the country to monitor and censor all channels of communication, from private letters and telephone calls to public radio and television broadcasts. According to Archibald, only five of the 26 board members are working newsmen. “The rest are public relations men, businessmen, government employees, college professors, or are listed merely as ‘retired.’” CBS executive Theodore F. Koop, who served as deputy director of the Office of Censorship during World War II, is revealed as the head of board. Archibald reports that Koop took up the position in the mid-1960s. Later reports will suggest President Eisenhower appointed Koop to head the censorship board in 1958 (see 1958). In the wake of reports exposing government plans to censor public information in the event of a crisis (see October 1970), the Nixon administration changes the title of the secretive Office of Censorship to the Wartime Information Security Program (WISP). The WISP agency is run out of the Office of Emergency Preparedness (OEP), which is responsible for the highly classified Continuity of Government (COG) program (see October 21, 1968). The number of board members within the WISP unit, originally set at 26 (see 1958), is scaled down to just eight. The agency maintains the same basic objective of censoring public information in the event of a crisis. Author Ted Galen Carpenter will later report that “virtually nothing” changes in regards to the censorship plans. In the event of a national emergency, “press censorship would go into effect and several thousand ‘executive reservists’ would report to locations across the country to censor all mail, cables, telephone calls, and other communications (including press dispatches) entering or leaving the United States.” Under the WISP program, the government would not only censor information that may help an enemy, but also any data that “might adversely affect any policy of the United States.” Time magazine will later summarize, “Press reports in 1970 exposed the existence of a standby national censor and led to the formal dissolution of the censorship unit, but its duties were discreetly reassigned to yet another part of what an internal memo refers to as the ‘shadow’ government.” [Time, 8/10/1992; Carpenter, 1995, pp. 114]
The Senate Subcommittee on Constitutional Rights, chaired by Senator Sam Ervin, uncovers the existence of a sophisticated computer system used by the Department of Defense to monitor US citizens suspected of “subversive” activities. The system is operated from the military’s “domestic war room,” overseen by the Directorate of Civil Disturbance and Planning Operations in the basement of the Pentagon (see April 1968). It is designed to keep track of “all public outbursts and political dissent” inside the United States. The Senate subcommittee uncovers a database of thousands of US citizens labeled as possible threats to national security. According to New Times magazine, the subcommittee discovers “computerized files on 18,000 of the celebrated to obscure, on people such as Senator George McGovern and former Massachusetts Gov. Francis Sargent down to ordinary citizens who had, sometimes unknowingly, become ‘associated with known militant groups.’” [New Times, 11/28/1975]
Congress revokes emergency detention provisions within the 1950 Subversive Activity Control Act in an attempt to ban the FBI’s controversial “Security Index” program. The decades-old Security Index lists thousands of citizens that are to be targeted for surveillance and/or detention in the event of a national emergency or war (see Early 1943-1971 and 1943). The FBI will still maintain the list in anticipation of the program’s reactivation. The FBI and the Justice Department will evade the Congressional ban by allowing the FBI to reestablish the list under a new name in late 1971 (see Late 1971). [New York Times, 8/3/1975]
California Governor Ronald Reagan establishes the California Specialized Training Institute (CSTI) to oversee disaster training and exercises for the state. The CSTI, which will serve as a branch of the governor’s Office of Emergency Services, will prepare emergency personnel for a variety of scenarios ranging from terrorist attacks, to environmental hazards, to civil disturbances. The creation of the institute was recommended by participants in the exercises Cable Splicer II and Cable Splicer III (see March 1969 and May 1970). The facility, built with a $425,000 grant from the Federal Law Enforcement Assistance Administration, is meant to duplicate the functions of the Senior Officers Civil Disturbance Course (SEADOC) in Fort Gordon, Georgia. The CSTI will be criticized for training police officers to use military-style tactics in domestic law enforcement situations. It will teach a controversial program known as the Civil Emergency Management Course (see September 1971). Reagan appoints Louis O. Giuffrida, a US Army colonel, to head the CSTI. A year earlier, Giuffrida wrote a paper advocating martial law and the emergency roundup of 21 million “American Negroes” to “assembly centers or relocation camps” in the event of a militant uprising by African Americans (see 1970). Giuffrida will later be appointed to head the Federal Emergency Management Agency (FEMA) during Reagan’s presidency (see May 18, 1981). Documents from the FBI describing extensive domestic surveillance of college students, minorities, and war protesters are anonymously mailed to several major newspapers and members of Congress. The records are sent to the New York Times, the Washington Post, the Los Angeles Times, Senator George S. McGovern (D-SD), and Representative Parren J. Mitchell (D-MD). According to the New York Times, “The documents suggest that FBI surveillance of dissenters on the political left has been far more extensive than was generally known.” The papers “show that the subjects of inquiries include obscure persons marginally suspected of illegal activity.” The files describe attempts to infiltrate colleges, student unions, minority groups, and political organizations. According to the documents, the FBI is under orders to investigate all students, teachers, and scientists that travel to the Soviet Union. The documents show that the FBI has gone as far as investigating a Boy Scout trip to the Soviet Union. The papers also reveal that the FBI is under orders to monitor all student groups that are “organized to project the demands of black students.” The files also state that FBI Director J. Edgar Hoover approved plans for the recruitment of informants as young as 18 years old. [New York Times, 3/25/1971]
The California Specialized Training Institute (CSTI) begins teaching a program known as the Civil Emergency Management Course. The course teaches a variety of controversial methods for dealing with public uprisings and civil unrest. According to New Times magazine, techniques taught include “press manipulation, computerized radical spotting, logistical support from other agencies, [and] martial rule.” The program will be attended by thousands of “officials from the National Guard, the Army, local police forces, fire services, city government, courts, legislatures, utilities, prisons, and private corporations.” It involves three days of training, followed by a day-long exercise, a critique of the exercise, and another work session. A final day is “highlighted by discussion of ‘reduced lethality weapons’ and student movement infiltrators.” [New Times, 11/28/1975]
The FBI, acting against the will of Congress, maintains a secret list of citizens to be monitored and/or detained in the event of a national emergency. Congress recently attempted to ban the FBI’s secret “Security Index” by revoking the Emergency Detention Act of the 1950 Subversive Activity Control Act (see 1971). The FBI, in an apparent attempt to subvert the repeal, changes the title of the detention list to the “Administrative Index,” or “ADEX” for short. A source from the FBI will say the change is in “name only.” Another FBI official acknowledges that the new index could be “interpreted as a means to circumvent [the] repeal of the Emergency Detention Act.” The Justice Department secretly decides that Congress has not restricted the FBI’s authority. In a memo to J. Edgar Hoover, Attorney General John N. Mitchell says the repeal by Congress does “not alter or limit” the FBI’s authority to “record, file, and index” names of purportedly subversive individuals. According to Mitchell, the FBI maintains plans for a national emergency that are “prepared on the basis of authority other than” the provisions revoked by Congress. The Senate Select Committee on Intelligence will later report that the FBI “continued to evade the will of Congress, partly with Justice Department approval, by maintaining a secret administrative index of suspects for round-up in case of a national emergency.” The FBI will maintian control of the list until 1985, when it will be transferred to FEMA (see Late 1971-1985 and 1985). The FBI maintains a list of individuals to be closely monitored and possibly detained in the event of a national emergency. The list, known as the Administrative Index, or “ADEX,” is a continuation of the FBI’s Security Index, which was banned by Congress in 1971 (see 1971 and Late 1971). FBI Director Clarence M. Kelley says the index is a “readily available and up-to-date list of individuals deemed dangerous to the internal security and who would be afforded priority investigative coverage in the event of a national emergency.” The list is updated monthly and contains thousands of names of dissidents, anti-war protesters, and others considered to be potential risks in times of emergency. Sources tell the New York Times the index lists background information, history, and “nationalistic tendencies” of each subject. Kelley assures members of Congress that the list includes “only those individuals who pose a realistic, direct, and current danger to the national security.” The Senate Select Committee on Intelligence reports in April 1976 that the FBI abolished the index, but reports will later claim that the list is kept by the FBI well into the 1980s and transferred to the Federal Emergency Management Agency in 1985 (see 1985). President Richard M. Nixon reorganizes the Office of Civil Defense (OCD), which is responsible for parts of the federal government’s emergency civil defense and continuity of government plans, into a new organization within the Department of Defense called the Defense Civil Preparedness Agency (DCPA). The DCPA, according to the Department of Defense, “will provide preparedness assistance planning in all areas of civil defense and natural disasters. The goals of the DCPA are to provide an effective national civil defense program and planning guidance to state and local governments in their achievement of total disaster preparedness.” [Virgin Islands Daily News, 5/9/1972, pp. 6; B. Representative William S. Moorhead (D-PA) publicly criticizes a secret government contingency plan to censor public information in the event of a national emergency or war. Moorhead claims he has obtained a copy of the plan as part of an investigation by the House Foreign Operations and Government Information Subcommittee. His primary concern is that the censorship plans could be implemented in the event of a “limited war,” such as the conflict in Vietnam. According to Moorhead, representatives of the Office of Emergency Preparedness (OEP), which is responsible for managing the secret censorship program, testified to the committee that the plans were for use only in the event of nuclear attack within the United States. Moorhead, however, after reviewing the plans first-hand, says the program could be activated during “limited war or conflicts of the ‘brush fire’ type, in which United States forces are involved elsewhere in the world on land, sea, or in the air.” The plans would involve “opening mail, monitoring broadcasts, and questioning travelers entering the country.” Moorhead says James W. McCord Jr., who was arrested as part of the Watergate scandal (see June 17, 1972), was one of several individuals responsible for drafting the plans. Moorhead alleges McCord developed a “National Watchlist” as part of the program. [United Press International, 10/23/1972; United Press International, 10/23/1972]
President Nixon eliminates the Office of Emergency Preparedness (OEP), and transfers its functions to the General Services Administration (GSA) and the Department of Housing and Urban Development (HUD). The GSA will take over the agency’s civil defense, continuity of government, resource management, and other emergency preparedness functions, while HUD will be responsible for disaster preparedness and relief. Wayne Blanchard, 2/5/2008, pp. 18] Similar emergency planning responsibilities are held by the Defense Civil Preparedness Agency, which was established by Nixon within the Department of Defense in May 1972 (see May 5, 1972).
Trans World Airlines Flight 514, a Boeing tri-jet 727 carrying 85 passengers and seven crew members from Columbus, Ohio, to Washington, DC, prematurely descends and slams into a 2,000-foot-high peak in the Blue Ridge Mountains, approximately 50 miles west of the nation’s capital. All 92 people on board are killed. The crash occurs near a highly classified underground installation known as Mount Weather. The incident will draw significant public attention to the secret bunker for the first time since its construction in the 1950s (see 1952-1958). A federal spokesman will refuse to answer questions regarding the complex, but will say the facility is run by the Office of Preparedness, which is responsible for “continuity of government in a time of national disaster.” The Office of Preparedness was formally known as the Office of Emergency Preparedness (see October 28, 1969).
Misunderstanding Blamed for Crash - The National Transportation Safety Board will later rule by split decision that the crash was caused by a misinterpreted instruction given to the pilots by an air traffic controller at Dulles International Airport. The controller alerted the pilots that the flight was “cleared for approach,” which the flight crew incorrectly assumed gave them a clear path to descend to 1,800 feet. Experts will tell the NTSB that the phrase “cleared for approach” is open to misunderstanding. Three of the five board members will fault the plane crew for misinterpreting the command, while the other two will place responsibility on the air traffic controller for not specifically telling the flight to maintain its altitude. The Federal Preparedness Agency, later renamed the Federal Emergency Management Agency (FEMA), has its own domestic surveillance system in place, according to an investigation by Senator John Tunney (D-CA). He finds that the agency is maintaining electronic dossiers on at least 100,000 Americans that contain information gleaned from wide-ranging computerized surveillance. The database is located in the agency’s secret underground city at Mount Weather, near Bluemont, Virginia. The senator’s findings will be confirmed in a 1976 investigation by the Progressive magazine, which will find that the Mount Weather computers “can obtain millions of pieces [of] information on the personal lives of American citizens by tapping the data stored at any of the 96 Federal Relocation Centers”—a reference to other classified facilities. According to the Progressive, Mount Weather’s databases are run “without any set of stated rules or regulations. Its surveillance program remains secret even from the leaders of the House and the Senate.” [Radar, 5/2008]
By administrative order, the Federal Preparedness Agency (FPA) is established within the General Services Administration (GSA) to oversee federal planning for potential national emergencies. The agency will focus on civil defense, continuity of government, and resource management, responsibilities that were transferred to the GSA by President Nixon in 1973 (see July 1, 1973). [Wing and Walton, 1/1980, pp. 35]
Senator John V. Tunney, chairman of the Subcommittee on Constitutional Rights, claims Mount Weather, a secret government facility located about 50 miles west of Washington, DC (see 1952-1958), has collected and stored data on at least 100,000 US citizens. During a Congressional hearing into reports of domestic surveillance, Tunney alleges, “computers—described as ‘the best in world’—can obtain millions of pieces of information on the personal lives of American citizens.” Mount Weather maintains a state-of-the-art surveillance system as part of the facility’s Civil Crisis Management program (see 1967-1976). General Robert T. Bray, who is called to testify at the hearing, refuses to answer repeated questions regarding the data collection programs. Bray says he is “not at liberty” to disclose “the role and the mission and the capability” at Mount Weather, “or any other precise location.” Mount Weather and nearly 100 other “Federal Relocation Centers” are considered a key aspect of the highly classified Continuity of Government (COG) program (see 1950-1962), which is designed to ensure the survival of the federal government in times of national emergency. Bray admits to committee members that Mount Weather stores data relating to “military installations, government facilities, communications, transportation, energy and power, agriculture, manufacturing, wholesale and retail services, manpower, financial, medical and educational institutions, sanitary facilities, population, housing shelter, and stockpiles.” Senator James Abourezk says, “the whole operation has eluded the supervision of either Congress or the courts.” Senator Tunney says Mount Weather is “out of control.” [Progressive, 3/1976]
The existence of Mount Weather, a secret underground government installation located about 50 miles west of Washington, DC (see 1950-1962), which houses a parallel executive branch that is prepared to take control of the country in the event of a national emergency, is revealed in an article published by The Progressive. According to the article, the secret government-in-waiting is part of the highly classified Continuity of Government (COG) program, which is meant to keep the government functioning in times of disaster. The backup executive branch at Mount Weather attempts to duplicate the functions of the federal government on a day-to-day basis. Should a catastrophe kill or incapacitate the nation’s leaders, the parallel branch will be ready to assume power and re-establish order. The secret government-in-waiting at Mount Weather includes the departments of State, Treasury, Commerce, Agriculture, Health, Interior, Labor, Transportation, and Housing and Urban Development. High-level government officials tell journalist Richard P. Pollock of The Progressive that each federal department at Mount Weather is headed by a single person. These officials form a parallel cabinet and are even referred to by subordinates as “Mr. Secretary.” These alternate cabinet members are appointed by the White House and serve indefinite terms. Many of the officials have held their positions through several administrations. There is also an Office of the Presidency at Mount Weather. According to The Progressive, the Federal Preparedness Agency (FPA) “apparently appoints a special staff to the presidential section, which regularly receives top-secret national security estimates and raw data from each of the federal departments and agencies.” The Progressive adds: “According to a source within the FPA, Mount Weather publishes its own independent reports and drafts its own evaluation of the policies and programs of the federal government. The underground installation also prints in-house reports on hundreds of national and regional topics, including the state of the nation’s economy, health, education, military preparedness, and political trends, the source said.” Pollock comments, “How can a parallel—even if dormant—government be constitutionally acceptable, if Congress has played no significant role in its formation and exercises no control over its day-to-day operations?” [Progressive, 3/1976]
The Federal Emergency Management Agency (FEMA) is established to oversee federal planning for natural disasters, nuclear accidents, terrorist attacks, and other potential emergencies. The Carter Administration sought the creation of FEMA after the nation’s emergency response plans came under strong criticism for being disorganized and spread across numerous bureaucratic agencies. Pursuant to Reorganization Plan No. 3 of 1978 and Executive Order 12127, FEMA will now consolidate several disaster and emergency preparedness agencies into a single agency within the executive branch. FEMA will incorporate the Defense Civil Preparedness Agency, the Federal Preparedness Agency, the Federal Insurance Administration, the Federal Disaster Assistance Administration, the National Fire Prevention and Control Administration, the National Fire Academy, and the Community Preparedness Program. It will also take over several programs formally run out of the Executive Office of the President, including those pertaining to earthquake preparedness, management of terrorist attacks, dam safety, and the nation’s emergency warning and broadcasting systems. The Federal Emergency Management Agency (FEMA), known best as a relief agency for victims of natural disasters, is secretly dedicated to the highly classified Continuity of Government (COG) program, which is meant to ensure the survival of the federal government in times of national emergency. Upon its establishment, FEMA absorbs the Defense Civil Preparedness Agency (DCPA) and the Federal Preparedness Agency (FPA), which were previously responsible for the top-secret plans (see April 1, 1979). During the 1980s and into the early 1990s, FEMA’s budget and workforce are overwhelming geared towards the COG program (see 1982-1991 and February 1993). FEMA remains in charge of overseeing the government’s continuity plans up to present day. According to FEMA’s website, the agency’s Office of National Continuity Programs (NCP) is currently the “Lead Agent for the Federal Executive Branch on matters concerning continuity of national operations under the gravest of conditions.” [fema.gov, 6/4/2009]
The National Program Office (NPO), which is responsible for the highly classified Continuity of Government program, establishes a secret line of presidential succession for certain “narrowly defined” emergency situations. According to the traditional legal line of succession, should the president of the United States be killed or incapacitated, he is to be replaced by the vice president, followed by the Speaker of the House of Representatives, then by the President Pro Tempore of the Senate, then each cabinet member from the Secretary of State down. The alternative succession plan developed by the NPO, known officially as the Presidential Successor Support System, or “PS cubed,” would suspend these traditional rules and allow a small group of officials to appoint a new government. A source with knowledge of the plan says it would “suspend that natural succession and these individuals would have the right to appoint, virtually appoint, a new government.” The program, according to author James Mann, calls for “setting aside the legal rules of presidential succession in some circumstances, in favor of a secret procedure for putting in place a new ‘president’ and his staff.” The idea is to “concentrate on speed, to preserve ‘continuity of government,’ and to avoid cumbersome procedures; the speaker of the House, the president pro tempore of the Senate, and the rest of Congress would play a greatly diminished role.” The alternative succession plan allows the presidency, the vice presidency, and each cabinet position to be filled by individuals from both inside and outside the active government. In 1991, CNN will list the names of several people that may assume power should the plan be put into action, including Dick Cheney, Howard Baker, Richard Helms, Jeane Kirkpatrick, James Schlesinger, Edwin Meese, Dick Thornburgh, and Tip O’Neill. Some participants say the alternative succession plan is absolutely necessary to ensure the survival of the federal government, but others argue the secrecy of the program undermines its credibility. “If no one knows in advance what the line of succession is meant to be,” says a constitutional scholar from Duke University, “then almost by hypothesis no one will have any reason to believe that those who claim to be exercising that authority in fact possess it.” [CNN Special Assignment, 11/17/1991; Atlantic Monthly, 3/2004]
Lieutenant Colonel Oliver North uses a sophisticated brand of software known as PROMIS to track potential security threats in the United States. Intelligence officials will later tell Wired magazine that North has a command center connected to a larger Justice Department facility utilizing the software. “According to both a contractor who helped design the center and information disclosed during the Iran-Contra hearings,” North maintains a “similar, but smaller, White House operations room… connected by computer link to the [Justice Department]‘s command center.” According to Wired, North uses computers in his operations center to track “dissidents and potential troublemakers within the United States as part of a domestic emergency preparedness program.” North is assigned to work with FEMA on the secretive Continuity of Government (COG) program from 1982 to 1984 (see 1982-1984). Wired will later report, “Using PROMIS, sources point out, North could have drawn up lists of anyone ever arrested for a political protest, for example, or anyone who had ever refused to pay their taxes.” Compared to PROMIS, Wired notes, “Richard Nixon’s enemies list or Sen. Joe McCarthy’s blacklist look downright crude.” [Wired News, 3/1993]

Ford Library] (click image to enlarge)Throughout the 1980s, Dick Cheney and Donald Rumsfeld are key players in one of the most highly classified programs of the Reagan administration. Presently, Cheney is working as a Republican congressman, while Rumsfeld is head of the pharmaceutical company G. D. Searle. At least once per year, they both leave their day jobs for periods of three or four days. They head to Andrews Air Force Base, near Washington, DC, and along with 40 to 60 federal officials and one member of the Reagan Cabinet are taken to a remote location within the US, such as an underground bunker. While they are gone, none of their work colleagues, or even their wives, knows where they are. They are participating in detailed planning exercises for keeping government running during and after a nuclear war with the Soviet Union.
Unconstitutional 'Continuity of Government' - This highly secret “Continuity of Government” (COG) program is known as Project 908. The idea is that if the US were under a nuclear attack, three teams would be sent from Washington to separate locations around the US to prepare to take leadership of the country. If somehow one team was located and hit with a nuclear weapon, the second or third team could take its place. Each of the three teams includes representatives from the State Department, Defense Department, CIA, and various domestic-policy agencies. The program is run by a new government agency called the National Program Office. Based in the Washington area, it has a budget of hundreds of million dollars a year, which grows to $1 billion per year by the end of Reagan’s first term in office. Within the National Security Council, the “action officer” involved in the COG program is Oliver North, who is a key figure in the mid-1980s Iran-Contra scandal. Reagan’s Vice President, George H. W. Bush, also supervises some of the program’s efforts. As well as Cheney and Rumsfeld, other known figures involved in the COG exercises include Kenneth Duberstein, who serves for a time as President Reagan’s chief of staff, and future CIA Director James Woolsey. Another regular participant is Richard Clarke, who on 9/11 will be the White House chief of counterterrorism (see (1984-2004)). The program, though, is extraconstitutional, as it establishes a process for designating a new US president that is nowhere authorized in the US Constitution or federal law. After George H. W. Bush is elected president in 1988 and the effective end of the Soviet Union in 1989, the exercises continue. They will go on after Bill Clinton is elected president, but will then be based around the threat posed by terrorists, rather than the Soviet Union (see 1992-2000). According to journalist James Mann, the participation of Rumsfeld and Cheney in these exercises demonstrates a broader truth about them: “Over three decades, from the Ford administration onward, even when they were out of the executive branch of government, they were never too far away; they stayed in touch with its defense, military, and intelligence officials and were regularly called upon by those officials. Cheney and Rumsfeld were, in a sense, a part of the permanent, though hidden, national security apparatus of the United States.” [Mann, 2004, pp. 138-145; Atlantic Monthly, 3/2004; Washington Post, 4/7/2004; Cockburn, 2007, pp. 85]
No Role for Congress - According to one participant, “One of the awkward questions we faced was whether to reconstitute Congress after a nuclear attack. It was decided that no, it would be easier to operate without them.” Thus the decision is made to abandon the Constitutional framework of the nation’s government if this plan is ever activated. [Dubose and Bernstein, 2006, pp. 198]
Reactivated after 9/11 - The plan they rehearse for in the COG exercises will be activated, supposedly for the first time, in the hours during and after the 9/11 attacks (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). [Washington Post, 3/1/2002] Mann subsequently comments, “The program is of particular interest today because it helps to explain the thinking and behavior of the second Bush Administration in the hours, days, and months after the terrorist attacks on September 11, 2001.” [Atlantic Monthly, 3/2004]
As a part of the plan to ensure Continuity of Government (COG) in the event of a Soviet nuclear strike or other emergency, the US government begins to maintain a database of people it considers unfriendly. A senior government official who has served with high-level security clearances in five administrations will say it is “a database of Americans, who, often for the slightest and most trivial reason, are considered unfriendly, and who, in a time of panic, might be incarcerated. The database can identify and locate perceived ‘enemies of the state’ almost instantaneously.” He and other sources say that the database is sometimes referred to by the code name Main Core, and one says it was set up with help from the Defense Intelligence Agency.
Alleged Link to PROMIS - The database will be said to be linked to a system known as PROMIS, the Prosecutor’s Management Information System, over which the US government conducts a long-lasting series of disputes with the private company Inslaw. The exact connection between Main Core and PROMIS is uncertain, but one option is that code from PROMIS is used to create Main Core. PROMIS is most noted for its ability to combine data from different databases, and an intelligence expert briefed by high-level contacts in the Department of Homeland Security will say that Main Core “is less a mega-database than a way to search numerous other agency databases at the same time.”
Definition of National Emergency - It is unclear what kind of national emergency could trigger such detention. Executive orders issued over the next three decades define it as a “natural disaster, military attack, [or] technological or other emergency,” while Defense Department documents include eventualities like “riots, acts of violence, insurrections, unlawful obstructions or assemblages, [and] disorder prejudicial to public law and order.” According to one news report, even “national opposition to US military invasion abroad” could be a trigger.
How Does It Work? - A former military operative regularly briefed by members of the intelligence community will be told that the program utilizes software that makes predictive judgments of targets’ behavior and tracks their circle of associations using “social network analysis” and artificial intelligence modeling tools. “The more data you have on a particular target, the better [the software] can predict what the target will do, where the target will go, who it will turn to for help,” he will say. “Main Core is the table of contents for all the illegal information that the US government has [compiled] on specific targets.”
Origin of Data - In 2008, sources will reportedly tell Radar magazine that a “host of publicly disclosed programs… now supply data to Main Core,” in particular the NSA’s domestic surveillance programs initiated after 9/11. [Radar, 5/2008]
Protesters, now including workers, farmers, police, soldiers, and members of the League of Communists of Yugoslavia, along with the students, continue to demonstrate, and in greater numbers, demanding the release of those arrested earlier and more. Some say that Kosovo should be a Yugoslav republic, instead of an autonomous province, or join Albania. Many Serbs agree with Tihomir Vlaskalic, president of the Central Committee of the Serbian LCY, who says, “We have taken it for granted that Kosovo has its own Republic in Yugoslavia—the Socialist Republic of Serbia.” On March 26, students in Pristina attack Serbs and Monenegrins, and rob and burn houses and businesses. Students in Podujeve, Vucitern, Gjakova, Gjilan, Ferizaj, and Mitrovice join in on April 1-2. Serbia calls in the Yugoslav police and army and fighting occurs during a state of emergency, prohibition on gathering, and a curfew on April 2, throughout Kosovo. Thirty thousand soldiers and tanks are deployed, which some Albanians see as an occupation. Kosovo LCY President Mahmut Bakalli urges the military and police not to guard the radio and TV studios, because it would inflame the public. The last large demonstration is the May 18 occupation of Pristina University dormitories, which is ended by police using tear gas on May 19. The university is closed and its University Council is disbanded. High school students are expelled for demonstrating. More than 1,000 LCY members will be expelled or unilaterally removed from membership, and 11 LCY basic organizations will be disbanded during the emergency measures. Two months later martial law will end, but major towns are patrolled by security forces and covert officers of the Yugoslav Ministry of the Interior afterward.
Casualties - From March 11 to April 2, nine Albanians and a Serb policeman are killed, according to the Yugoslav government. In 1989 a Yugoslav source will say the wounded include 75 Albanians (55 of whom were wounded by gunshots), three militia with serious injuries, and 127 with less serious wounds. Kosovar Albanian sources say as many as 1,000 are killed and even more hurt. Amnesty International will later say that the Serbian LCY Central Committee was told more than 300 were killed. In 1992 the Council for the Defense of Human Rights and Freedoms, located in Pristina, will find only 13 Albanians known to have been killed.
Government Countermeasures - Around 1,400 Albanians are given prison terms of up to 15 years, 3,000 given sentences of up to three months in prison, and 6,000 are otherwise punished. During the summer break, almost 300 students are given trials as brief as a few hours, and given up to 15-year prison terms. In June, the government says 506 people were summarily fined or jailed for up to 60 days under the Code for Petty Offenses. By August 31, another 245 people are given one to 15-year prison terms by the federal authorities and 60 people are convicted in September. The education minister of Croatia and other Croatian and Slovenian authorities will say Serbia should be less draconian. Many professors will be blacklisted in the Komunist magazine. The Kosovo Committee of the LCY calls for a 10 percent smaller student body at Pristina University and dispersal of some departments elsewhere in the province. When the fall semester begins in September, Albanian history, literature, language, culture, and art courses will be censored. Translated Serbian textbooks replace uniformly banned textbooks from Albania. The number of Albanian students, and their former quota of two-thirds of the student body, will be reduced annually.
Continuing Unrest - For years after spring 1981, government offices, monuments, and Serb graves will be vandalized and subversive literature circulated in Kosovo, western Macedonia, and parts of Montenegro. Slavs will begin to leave Kosovo out of intimidation rather than for economic reasons, and refer to threats, attacks, murder, arson, and vandalism. Many settle in Smederevo, Kragujevac, Nis, Kraljevo, Svetozarevo, and Belgrade. Belgrade residents insultingly call them Vrcani, and reportedly Slavs from Kosovo are considered tainted by association with Albanians. [Vickers, 1998, pp. 197 - 209, 212-213; Kola, 2003, pp. 157-158, 162]
The Party of Labor of Albania’s newspaper, Zeri i Popullit, prints an article on April 8, condemning Yugoslavia’s police actions and the treatment of Yugoslav Albanians, and supporting the protest demands. It also says, “The London and Versailles Treaties, which settled the frontiers between Yugoslavia and Albania, can no longer be imposed to the detriment of the Albanian people.” PLA First Secretary Enver Hoxha may be the anonymous author of the article. A Zeri i Popullit article two weeks later says hundreds were killed, wounded, missing, or arrested, and that it is Albania’s right to condemn Yugoslavia’s repeated actions, which it has not done officially. Zeri i Popullit points to Yugoslavia’s charges about the treatment of Croats and Slovenes across its border in Carinthia, which the article compares to Albanian concerns about Kosovar Albanians. Albania denies seeking to annex Kosova. The Yugoslav government sees these articles as evidence that Albania is behind the demonstrations, after initially blaming domestic and Western sources. As a result, previously increasing economic and cultural cooperation between the two countries will be reduced. On April 29, Lazar Kolisevski, a member of the Yugoslav Presidency, presents a report to a meeting of the Presidency and the Federal Council for the Protection of the Constitutional Order, charging that the PLA caused the demonstrations, which were “hostile and counter-revolutionary,” and sought unification with Albania. Kolisevski calls nationalism the greatest threat to Yugoslavia and says “economic nationalism,” economic divisions between groups in Yugoslavia, is the main cause of friction, which a Zeri i Popullit article also pointed out.
Allegedly PLA-Linked Kosovar Groups - Several allegedly PLA-linked organizations will be blamed for the protests: the Revolutionary Movement of Albanian Unification (whose leader, Adam Demaci, has been in jail since 1975), the Red Popular Front (considered closer to the PLA), eight “irredentist” groups arrested before the events, and the Albanian Communist Marxist-Leninist Party in Yugoslavia (represented at the 8th Congress of the PLA, in September 1981, and having almost the same program as the PLA). Besides these “extremists,” Kosovo President Xhavid Nimami blames “Ballists” led by Abaz Ermeni and “Zogists” led by Leka Zog, Zog I’s son, and equates calls for “united Albanians” to “United Serbs,” etc., saying they would destroy Yugoslavia. In 1997 an anonymous high-ranking official will allege that a meeting of officials and professors was held in Tirana to propose inciting Kosovars to seek more rights. Albanian anti-communist scholar Paulin Kola will suggest that this was done to distract Albanians from economic problems caused by the break in relations with China in the late ‘70s. Others will allege that Albania’s Sigurimi security agency organized the demonstrations, through ties with Albanians in Western Europe, especially Switzerland. Some Kosovars will say they received support from Albanians, but not from the Albanian government. Kola will point to the alleged role of the ex-communist Socialist Party of Albania in the formation of the KLA in the ‘90s as evidence that Albania was behind the 1981 events. In 1992-1993 and 2001 interviews, Xhafer Shatri will tell Kola that he thought the March 1981 demonstrations were unplanned. On the other hand, Albania benefits from trade with Yugoslavia and Yugoslavia acts as a buffer against the USSR. Albania will repatriate 249 Kosovar Albanian asylum seekers back to Yugoslavia from 1981 to 1983.
Alleged Soviet Involvement - In late April, Yugoslavia’s Fadil Hoxha says “Greater Albanian nationalism” would destabilize the Balkans as much as other nationalisms, and implies that the USSR wants to destabilize the Balkans to undermine the Non-Aligned Movement. In June, Zeri i Popullit will accuse the USSR of trying to use Serbia’s crackdown to cause problems in the Balkans and NATO. [Vickers, 1998, pp. 202-207, 211-212; Kola, 2003, pp. 158-160, 163]

Louis O. Giuffrida is confirmed by the Senate to become the next director of the Federal Emergency Management Agency (FEMA). Guiffrida, who was recently promoted to the rank of general in the California National Guard, served under President Reagan when Reagan was governor of California. Giuffrida headed the California Specialized Training Institute (CSTI) (see 1971) and was an “adviser on terrorism, emergency management, and other special topics.” According to Reagan, Giuffrida has a “lengthy career as a military and civilian expert in crime prevention and investigation, industrial defense, physical security, civil disturbances and disasters, confinement, and rehabilitation responsibilities.” [Nomination of Louis O. Giuffrida To Be Director of the Federal Emergency Management Agency, 2/24/1981; Bumgarner, 1/18/2008, pp. 142] Giuffrida wrote a paper while at the US Army War College advocating martial law and the emergency roundup and detention of millions of “American Negroes” (see 1970). He will resign in 1985 amid allegations of corruption (see July 24, 1985).
President Reagan announces the creation of the Emergency Mobilization Preparedness Board (EMPB) “to improve mobilization capabilities and interagency cooperation within the federal government to respond to major peacetime or war-related emergencies.” The board will study emergency preparedness responsibilities and make policy suggestions to the president, the National Security Council (NSC), and the Federal Emergency Management Agency (FEMA). According to the White House, the new board consists of “representatives from 22 federal agencies at the deputy secretary or under secretary level, and is chaired by the assistant to the president for national security affairs.” A full-time secretariat, chaired by a senior official from FEMA, is to oversee the EMPB and the implementation of its recommendations. The board will consist of 11 separate working groups: industrial mobilization, military mobilization, food and agriculture, government operations, emergency communications, civil defense, social services, human resources, health, law enforcement and public safety, and economic stabilization and public finance. The EMPB will later be criticized for becoming overly powerful and militarizing the nation’s emergency management programs. National security affairs expert Diana Reynolds will later comment: “By forming the EMPB, Ronald Reagan made it possible for a small group of people, under the authority of the NSC, to wield enormous power. They, in turn, used this executive authority to change civil defense planning into a military/police version of civil security.” [White House, 12/29/1981; Reynolds, 1990]

The program includes a special plane called the National Emergency Airborne Command Post (NEACP). This is a modified Boeing 747, based at Andrews Air Force Base, near Washington, DC that has its own conference room and special communications gear. Nicknamed the “Doomsday” plane, it could act as an airborne command post from where a president could run the country during a nuclear war. One of the COG exercises run by the Reagan administration involves a team of officials actually staying aloft in the NEACP for three days straight. The team cruises across the US, and up and down the coasts, periodically being refueled in mid-air. [Schwartz, 1998; Mann, 2004, pp. 144] Dick Cheney and Donald Rumsfeld participate in the COG exercises, though whether they are aboard the NEACP in this particular one is unknown. [Atlantic Monthly, 3/2004] The plan that is being rehearsed for in the exercises will be activated in response to the 9/11 attacks (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). Also on 9/11, three Doomsday planes (then known as “National Airborne Operations Center” planes) will be in the air, due to an exercise taking place that morning called Global Guardian (see Before 9:00 a.m. September 11, 2001). The PROMIS database application is used for a program called “Follow the Money” to track loans made by Western banks to the Soviet Union and its allies. The top-secret program is run for the National Security Council (NSC) by Norman Bailey, who uses NSA signals intelligence to track the loans. Bailey will later say that the PROMIS application is “the principal software element” used by the NSA and the Treasury Department in their electronic surveillance programs that track financial flows to the Soviet bloc, organized crime, and terrorist groups. According to Bailey, this program marks a significant shift in resources from human spying to electronic surveillance, as a way to track money flows to suspected criminals and American enemies. Over a 10-year period, from 1982 to 1991, FEMA spends $2.9 billion—about 78 percent of its total budget—on classified national security programs. As Cox News Service will later note, “That’s roughly 12 times more than the $243 million FEMA spent during those 10 years preparing for natural disasters such as hurricanes, earthquakes, and floods.” [Cox News Service, 2/22/1993]

According to the Miami Herald, the martial law plans would “suspend the Constitution in the event of a national crisis, such as nuclear war, violent and widespread internal dissent, or national opposition to a US military invasion abroad.” Sources will claim North is involved in a major domestic surveillance operation as part of the COG program (see 1980s and 1980s or Before). During investigations into the Iran-Contra affair, Representative Jack Brooks (D-TX) will be barred from asking North about his involvement with the plans and the secret program (see 1987). The National Program Office (NPO) secretly oversees the government’s highly classified Continuity of Government program. Established by a “top-secret” presidential directive in 1982, the NPO is tasked with ensuring the survival of the federal government in times of national emergency. The office, which reports to the vice president, is responsible for coordinating secret emergency plans across four organizations: the Federal Emergency Management Agency (FEMA), the Central Intelligence Agency (CIA), and the Departments of State and Defense. From 1982 to 1991 the office spends roughly $8 billion maintaining massive underground bunkers, developing high-tech hardware, and devising last-resort plans to keep the government functioning during a nuclear war. The existence of the NPO is not publicly disclosed until a 1991 investigation by CNN reveals the title of the office and concludes it is plagued by corruption, fraud, and abuses of authority. The National Preparedness Directorate within the Federal Emergency Management Agency (FEMA), which is responsible for overseeing parts the highly classified Continuity of Government (COG) program, develops and maintains a high-tech fleet of mobile command centers, known as Mobile Emergency Response Support (MERS) units. The MERS vehicles, crafted out of 18-wheel tractor-trailer trucks, are meant to provide federal leaders with the ability to not only escape a nuclear attack, but also monitor information and communicate with the rest of the government while on the move. The MERS units cost billions of dollars to develop and are packed with sophisticated technology. According to Cox News Service: “Sensitive radio, telephone, and satellite gear—much of it classified—is stored in custom-built trucks that resemble mobile bank vaults.… The mobile units can operate for a month without support. They include generators capable of powering a three-story airport terminal and a fuel tanker that can suck diesel fuel from whatever service stations survive the nuclear blast.” One truck carries a pop-up satellite dish and weighs 24 tons. Early models, however, are inundated with problems. When the first two MERS prototypes are tested in 1984, one gets wedged beneath a highway overpass because it is too tall, while the other causes a road to collapse because it is too heavy. There are also technical flaws. The communication system at the heart of the Continuity of Government program does not function properly from late 1985 until at least December 1990 (see Late 1985 and December 1990). Despite the complications, FEMA eventually constructs 300 MERS vehicles and stations them at secure facilities in Washington State, Massachusetts, Denver, southern Georgia, and rural Texas. Most of the MERS vehicles are used rarely, if ever. “Billions of dollars were spent on such equipment, much of which is now gathering dust in Army depots,” the New York Times reports in 1994. John Brinkeroff, deputy for national preparedness programs at the Federal Emergency Management Agency (FEMA), outlines plans for implementing martial law in the event of a national emergency. In a memorandum later obtained by the Miami Herald, Brinkeroff describes how FEMA and the military would take over the country in the event of a crisis. According to the Herald, the plans include “suspension of the Constitution, turning control of the United States over to FEMA, appointment of military commanders to run state and local governments, and declaration of martial law during a national crisis.” Although the term “national crisis” is not defined, the Herald will later report that it is understood to mean anything from nuclear war to “violent and widespread internal dissent or national opposition against a military invasion abroad.” A source will tell the Herald the contingency plan is authorized by an “executive order or legislative package that [President] Reagan would sign and hold within the NSC [National Security Council] until a severe crisis arose.” This may refer to emergency legislation drafted by the Reagan administration to amend the 1950 Defense Resources Act (see September 25, 1984) and proposed updates to Executive Order 11490 (see August 2, 1984). The Brinkeroff memo resembles a paper written in 1970 by the current head of FEMA, Louis O. Giuffrida, in which he advocated the roundup and transfer of at least 21 million “American Negroes” to “assembly centers or relocation camps” in the event of an emergency (see 1970). President Reagan signs classified National Security Decision Directive 55, Enduring National Leadership. The directive authorizes a dramatic expansion of the highly secretive Continuity of Government (COG) procedures, intended to ensure the survival of the federal government in times of extreme national emergency. NSDD-55 will spawn a new wave of ultra-secretive programs and policies aimed at protecting the federal government during disasters, particularly in cases of prolonged nuclear war. A clandestine branch of the Federal Emergency Management Agency (FEMA), known as the National Preparedness Directorate, will oversee many of the revamped COG programs. President Reagan’s directive substantially boosts spending for “government preparedness” within FEMA, from $21.9 million to $131 million a year. Spending for civil defense within FEMA is increased as well. Also around this time, a highly clandestine agency, the National Program Office (NPO), is established by way of a top-secret presidential directive (see (1982 -1991)). It is unclear, however, if this directive is NSDD-55, which is classified and never made public. NSDD-55 will be briefly mentioned years later in media reports, but details of its contents will remain unknown. Some information regarding the document’s background will be confused in the press. Cox News Service will mistakenly identify the order as National Security Directive 58, while the New York Times will report it was signed in January 1983. Records gathered by the Federation of American Scientists will date the directive September 14, 1982. The Port Authority of New York and New Jersey holds a drill at the World Trade Center based on the scenario of a plane crashing into one of the Twin Towers. Numerous agencies participate in the drill, which is held on a Sunday. As well as the Port Authority, these include the New York City Fire Department, the New York City Police Department, and the Emergency Medical Services. Guy Tozzoli, the director of the Port Authority’s World Trade Department, will describe the drill during a legislative hearing in 1993 (see (March 29, 1993)). He will recall that the Port Authority simulates the “total disaster” of “the airplane hitting the building” and participants simulate “blood coming out of people.” He will add that the drill is “a real preparation for a disaster.” [Newsday, 11/12/2001; Dwyer and Flynn, 2005, pp. 58-59] (During the hearing, Tozzoli will mistakenly recall the drill being conducted in the late 1970s, but it is in fact held in November 1982. [Dwyer and Flynn, 2005, pp. 274] ) The drill follows an incident in 1981, when an Argentine aircraft came within 90 seconds of crashing into the WTC’s North Tower as a result of having problems communicating with air traffic controllers (see February 20, 1981). Asked about the drill shortly after 9/11, Tozzoli will say it was held “just to have people trained within the city for that particular scenario [of a plane hitting the WTC].” The 1982 exercise appears to be the last “joint drill involving all the emergency responders” held at the WTC prior to the 9/11 attacks, 19 years later, according to New York Times reporters Jim Dwyer and Kevin Flynn. US Army Warrant Officer Robert Rendon, a convicted drug dealer and admitted black-marketer, is assigned to the ultra-secretive Continuity of Government (COG) program, which is designed to keep the federal government functioning in times of disaster. Rendon, who first enlisted in the Army in 1977, is hired despite telling Army officers involved with the secret program that he had been convicted of selling drugs to schoolchildren in Los Angeles in the 1970s and served about 15 months in prison. Rendon also tells Army officers that he ran a black market operation while stationed as an intelligence officer for two years in West Germany. He says he financed the black market operation with funds given to him for espionage assignments by the Army’s Intelligence and Security Command (INSCOM). Rendon says INSCOM case officers taught him how to conceal his past under questioning. He also admits to using drugs and soliciting prostitutes while serving as an Army officer. The Army promises not to expose Rendon’s past beyond the COG program and grants him one of the government’s highest security clearances. Rendon will be stationed at Fort Huachuca, Arizona, and will spearhead a campaign to discredit whistleblowers that attempt to expose corruption within the COG project, most notably Army intelligence veteran Tom Golden (see After July 1987). Rendon will serve in the secret program until 1989 and later join an Army counterespionage unit (see December 1990). [Philadelphia Inquirer, 12/16/1990]
Despite reports alleging the Wartime Information Security Program (WISP) has been shut down, an internal Pentagon memo reveals it is still in existence. The program, which is currently being run out of the Federal Emergency Management Agency (FEMA), is designed to censor public information in the event of a national emergency or war. It was supposedly shut down after Congress cut off funding for WISP in 1974 (see 1974). The recent memo, however, summarizes the WISP’s current objectives: “The National WISP provides for the control and examination of communications entering, leaving, transiting, or touching the borders of the United States, and voluntary withholding from publication, by the domestic public media industries, of military and other information which should not be released in the interest of the safety and defense of the United States and its allies.” Investigative columnist Jack Anderson will later report: “There has been no Congressional funding for work on the censorship program since 1974, but the Pentagon directive is still in effect. So, too, is Executive Order 11490, which outlines each federal agency’s responsibilities in time of ‘severe emergency.’” Anderson will add that FEMA has drafted “standby” legislation to activate the censorship plans “whenever the president shall deem that the public safety demands it.” [Ocala Star-Banner, 3/29/1986]
Richard Clarke, who will be the counterterrorism “tsar” on 9/11, regularly participates in a series of highly secret “Continuity of Government” (COG) exercises. [Washington Post, 4/7/2004] Throughout the 1980s, the COG exercises rehearse how to keep the federal government running during and after a nuclear war with the Soviet Union (see 1981-1992). After the fall of the Soviet Union, the exercises continue, but based instead around a possible terrorist attack on the United States (see 1992-2000). [Atlantic Monthly, 3/2004] In 2004, Clarke will reveal that he has participated regularly in these exercises over the previous 20 years. He recalls that he had “gone off into caves in mountains in remote locations and spent days on end in miserable conditions, pretending that the rest of the world had blown up, and going through the questions, going through the drill.” He adds: “Everyone there play acts that it’s really happened. You can’t go outside because of the radioactivity. You can’t use the phones because they’re not connected to anything.” He also describes the COG plan requiring coded communications, saying: “There’s an elaborate system for the people in this network, first of all, to verify each other’s identity. That person on the other end has a certain password and information that they have to pass for us to believe that they’re who they say they are.” [Washington Post, 4/7/2004; ABC News, 4/25/2004] Clarke was a senior analyst at the State Department since 1979, and rises to prominence during the Reagan administration when he becomes deputy assistant secretary of state for intelligence. [Washington Post, 3/13/2003; BBC, 3/22/2004] After being a member of the National Security Council since 1992, in 1998 he is appointed as counterterrorism “tsar” (see May 22, 1998). [9/11 Commission, 3/24/2004 ; New York Review of Books, 5/13/2004; Independent, 6/14/2004] According to journalist James Mann, the COG program is of particular interest because it helps explain the thinking and behavior of the Bush administration “in the hours, days, and months after the terrorist attacks on September 11, 2001.” [Atlantic Monthly, 3/2004] On the morning of 9/11, Clarke is in fact responsible for activating the COG plan, the first time it is ever implemented (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). [Clarke, 2004, pp. 8; ABC News, 4/25/2004] Also participating in the COG exercises, at least throughout at 1980s, are Dick Cheney and Donald Rumsfeld, who on 9/11 are the vice president and secretary of defense, respectively. Longtime US Army intelligence officer Tom Golden is assigned by the CIA to oversee government contracts within the highly classified Continuity of Government program, which is designed to keep the government functioning in times of disaster. Golden, who has served 20 years in the Army and has a history of tracking down misspending and malfeasance in classified programs, will now serve as chief of the operations security branch at the Information Systems Command in Fort Huachuca, Arizona. Future staff director of the House Armed Services Committee Rudy DeLeon will later say Golden has a “very clearly established track record for honesty” as a whistleblower. Golden will report several instances of waste, fraud, and abuse in July 1987 (see July 1987) and will soon after become the target of a retaliatory smear campaign (see After July 1987). Peter Caram. [Source: SRR Training]The New York Port Authority, which owns the World Trade Center, is aware of terrorism occurring around the world and that the WTC is vulnerable to attack. It has therefore created the Terrorist Intelligence Unit within its police department, headed by Detective Sergeant Peter Caram, to gather information about terrorist groups and assess the vulnerability of its numerous facilities to attack. On this day, Caram writes a memo to the assistant superintendent of the Port Authority Police Department, reporting that the FBI has uncovered a terrorist threat: Two supporters of Ayatollah Khomeini are allegedly planning to bomb the WTC in the near future. Although the attack never occurs, this is the first of numerous occasions during the 1980s where the WTC is considered a potential target for a terrorist attack. The Federal Emergency Management Agency (FEMA), in coordination with 34 other federal departments and agencies, conducts a large-scale “civil readiness” exercise to test the government’s response procedures for national emergencies. Readiness Exercise 84, dubbed Rex-84 for short, consists of two separate parts, Alpha and Bravo, both of which are conducted in conjunction with a Joint Chiefs exercise known as Night Train 84. Rex-84 Bravo focuses on potential “civil disturbances, major demonstrations, and strikes that would affect continuity of government and/or resource mobilization.” During the exercise, the government practices plans for imposing martial law, deploying military forces in US cities, and arresting civilians considered threats to national security. In a letter to National Security Adviser Robert McFarlane, Attorney General William French Smith strongly objects to martial law plans developed by the National Security Council and the Federal Emergency Management Agency (FEMA). Smith learns the full extent of the plans upon reviewing a proposal by the Reagan administration to change Executive Order 11490 (see October 28, 1969). The Reagan administration is holding the drafted changes, along with standby legislation to amend the 1950 Defense Resources Act (see September 25, 1984), in preparation for any emergency that may require a military-style takeover of the nation’s resources and population. The plans cover a range of crisis situations, including a nuclear attack, natural disasters, and civil unrest. Smith writes: “I believe that the draft executive order raises serious substantive and public policy issues that should be further addressed before this proposal is submitted to the president. In short I believe that the role assigned to the Federal Emergency Management Agency (FEMA) on the revised executive order exceeds its proper function as a coordinating agency for emergency preparedness.” Smith continues: “This department and others have repeatedly raised serious policy and legal objections to the creation of an ‘emergency czar’ role for FEMA. Specific policy concerns regarding recent FEMA initiatives include the abandonment of the principle of ‘several’ agency responsibility and the expansion of the definition of severe emergencies to encompass ‘routine’ domestic law enforcement emergencies. Legal objections relate to the absence of presidential or Congressional authorization for unilateral FEMA directives which seek to establish new federal government management structures or otherwise task cabinet departments and other federal agencies.” Despite the objections of the Justice Department, FEMA and the Reagan administration will not abandon the emergency doctrine. Before leaving office, Reagan will dramatically expand the government’s emergency powers and officially override Executive Order 11490 with Executive Order 12656 (see November 18, 1988). The Reagan administration prepares a reserve emergency bill to amend the 1950 Defense Resources Act. The legislation, which would be presented to Congress in the event of a crisis, would suspend the Constitution and give the president and the Federal Emergency Management Agency (FEMA) unprecedented powers to combat a disaster. Nationally syndicated columnist Jack Anderson comments, “Since FEMA’s draft legislation is a standby proposal, it will not be offered to Congress ahead of time—when it could be thoroughly debated—but only in the event of a national emergency, when Congress would supposedly be panicked into voting for a dictatorship.” The bill covers a range of emergencies, including nuclear war, natural disasters, financial crises, and civil disturbances. It would grant the government the authority to ration goods and resources, take control of the nation’s manufacturing base, and require all citizens to work in “activities essential to the national health, safety, or interest.” The bill would outlaw striking by workers, and those refusing to work or caught lying about the availability of manpower would be heavily fined or thrown in jail. It would grant the government the authority to seize real estate and personal property considered “necessary for the national defense purpose.” Datamation magazine says the plans would lead to a military takeover of the computer industry. The bill would give the government “unlimited powers to seize computers and plants of high-technology industries and would establish an Office of Censorship to control telecommunications leaving the United States, making it a crime for companies to use secret codes.” [Ledger (Lakeland FL), 9/25/1984; Evening Independent, 10/17/1984]
The FBI Administrative Index, known as ADEX for short (see Late 1971-1985), is transferred to the Federal Emergency Management Agency (FEMA). The index contains the names and background information of approximately 12,000 individuals considered to be potential threats in times of crisis. Citizens on the list are to be closely monitored and/or detained in the event of a national emergency. Documents later obtained by the Austin American-Statesman will reveal an internal struggle between FBI Director William Webster, who recommends the FBI maintain control of the list, and Attorney General Edwin Meese, who, along with Reagan adviser Robert McFarlane, demands the list be handed over to FEMA. Systems Evaluations Incorporated, a company recently founded by Fred Westerman, a newly retired 20-year Army intelligence veteran, is contracted by the Army Corps of Engineers to help set up secret storage facilities in five states for the ultra-secretive Continuity of Government program. The Federal Emergency Management Agency (FEMA) and the clandestine National Program Office (see (1982 -1991)) will operate the facilities and oversee their construction. Within a year, Westerman will begin to report to government officials instances of waste, fraud, and abuse within the program (see 1986-1987). His job will be threatened in November 1987 (see November 1987) and his contract will be canceled in December of that year (see December 1987). Westerman will file a lawsuit against the government alleging FEMA burglarized Systems Evaluations’ offices in late 1987 (see Late 1987) and that the government launched a surveillance campaign against him (see November 1988). The lawsuit will be frozen when the Justice Department opens an investigation of Westerman (see November 1988) and the suit will later be sealed after an in-depth report highlighting Westerman’s case is published by a major magazine (see August 8, 1989). Westerman will lose another contract, along with his security clearances, in 1990 (see 1990), and by November 1991, he will be unemployable, several hundred thousand dollars in debt, and unable to gain any restitution from the government (see November 1991). Director of the Federal Emergency Management Agency Louis O. Giuffrida announces he will step down from his position on September 1. The announcement comes a day before a subcommittee is scheduled to officially approve a report detailing waste, fraud, and abuse at the nation’s disaster agency (see July 25, 1985). Giuffrida is singled out in the report for improperly using agency funds and committing possible perjury, although he says his resignation is unrelated to the subcommittee’s investigation. The House Science and Technology Subcommittee on Investigations, chaired by Tennessee Democrat Al Gore, officially approves a report detailing numerous instances of waste, fraud, and abuse at the Federal Emergency Management Agency (FEMA). The 18-month subcommittee investigation finds mismanagement at the highest levels of the agency. The report describes improper awarding of no-bid contracts, the use of agency funds to build luxurious living quarters for FEMA officials, acceptance of gifts by officials from contractors, and questionable payments to contractors. It states that FEMA Director Louis O. Giuffida has used agency funds to pay for first class plane tickets for his wife’s travel. The former third highest-ranking official at FEMA, Fred J. Villella, is accused of using government expenses to upgrade a chapel for his daughter’s wedding. The report says the Triton Corporation, a FEMA contracted company, gave Giuffrida, Villella, and their wives tickets to a $250-a-plate fundraiser held by a private club with ties to the Republican Party. It highlights conflicts in the sworn statements given to the subcommittee by Giuffrida and other agency officials, and recommends the Justice Department review their testimony for possible perjury. President Ronald Reagan signs a directive that contributes to the modern era of “continuity planning,” which will ensure the maintenance of a functioning government in the event of a catastrophic attack on Washington, DC. This Continuity of Government (COG) plan will be activated for the first time on 9/11, in response to the terrorist attacks that day (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). [Washington Post, 3/1/2002; ABC News, 4/25/2004] National Security Decision Directive 188 (NSDD 188), “Government Coordination for National Security Emergency Preparedness,” states that it is the policy of the United States to have capabilities at all levels of government to respond to a range of national security emergencies, “from major natural calamities to hostile attacks on the nation.” The US policy “includes an emergency mobilization preparedness program which provides an effective capability to meet defense and essential civilian needs during those emergencies.” The National Security Council (NSC) is assigned as the “principal forum” where the national security emergency preparedness policy will be considered, and the Federal Emergency Management Agency (FEMA) is to “assist in the implementation of this policy through a coordinating role with the other federal agencies.” NSDD 188 also assigns responsibility for continuity planning to an interagency panel that includes the Office of Management and Budget, and the Defense, Treasury, and Justice Departments. [US President, 9/16/1985; Washington Post, 3/1/2002] A subsequent executive order in 1988 will apply the COG plan to “any national security emergency situation that might confront the nation” (see November 18, 1988), and a presidential directive in 1998 will update it to specifically deal with the emerging threat posed by terrorists (see Early 1998 and October 21, 1998). Officials from the National Program Office (NPO), responsible for the highly classified Continuity of Government program, fake an exercise in front of congressional leaders in order to cover up equipment failures. At a secret site near Great Falls, Montana, Speaker of the House Tip O’Neill (D-MA) and Senate Appropriations Committee Chairman Robert Byrd (D-WV) gather with other key officials to witness the first major test of a new post-nuclear communication system. The high-tech system, worth millions of dollars, is meant to provide government leaders with the ability to communicate during and after a nuclear war. Much of the equipment, however, was purchased from separate contractors and is technically incompatible. The multi-million dollar system does not function properly, but NPO officials rig the exercise, paving the way for additional funding. As one participant will later explain: “At one point information was supposed to be sent out, and even though lights were blinking and the wheels were turning, the message was being sent by payphone about a block and a half from the site where the exercise was taking place.… Millions of dollars worth of equipment failed to function correctly and 25 or 50 cents worth of change and a pay telephone got the message through.” The visiting congressmen, who are responsible for allocating funds for the project, are fooled into thinking the system is fully functional. Money will continue to flow into the shoddy equipment for years to come. Sources will tell CNN five years later that the system is still not working properly. “Very few people knew about the scam and because the program is so classified there was no one they could tell,” CNN will report in 1991. Fred Westerman, a retired Army intelligence veteran who now heads a government contracted security firm, reports several instances of waste, fraud, and abuse within the highly secretive Continuity of Government (COG) program, which is supposed to ensure the survival of the federal government during disaster situations. Westerman’s company, Systems Evaluations Incorporated, was hired by the Army Corps of Engineers in 1985 to set up secret COG storage facilities around the country for the Federal Emergency Management Agency (FEMA) and the clandestine National Program Office (see 1985). Within a year, however, Westerman becomes disturbed by problems he notices within the secret COG program. He alerts officials that engine parts are falling off emergency vehicles at several secret sites. He reports that security systems and alarms at secure government facilities are faulty. He says doors and locks at the secret locations are weak and flimsy. He says his workers have been exposed to toxic chemicals from leaking containers at multiple government installations. Westerman reports that at one location water has seeped onto high-voltage electrical lines. He also becomes concerned about payments being made to companies for inadequate work. Westerman is repeatedly pressured by superiors not to complain about the problems, but nonetheless brings his complaints to the FBI, the Justice Department, and the inspector general’s office within FEMA. Westerman’s job will be threatened after he refuses to hand over corporate documents to a competitor (see November 1987). FEMA officials will allegedly burglarize Westerman’s office in search of the documents in late 1987 (see Late 1987). System Evaluation’s contract with the government will be canceled in December 1987 (see December 1987) and Westerman will later file a lawsuit against the government seeking reimbursement (see November 1988). The lawsuit will be frozen when the Justice Department opens an investigation of Westerman (see November 1988) and the suit will later be sealed after an in-depth report highlighting Westerman’s case is published by a major magazine (see August 8, 1989). Gonzalez (D-TX) claims the Federal Emergency Management Agency (FEMA) is prepared to detain 400,000 Central Americans residing in the United States in the event of an emergency. According to the Texas Observer, Gonzalez says reliable intelligence sources have informed him that the plan, if implemented, would also include a certain number of US citizens, noting that the agency maintains a list of “subversive” individuals to be monitored and/or apprehended in the event of a national emergency, a possible reference to the FBI’s Administration Index (see 1985). The New York Port Authority’s Office of Special Planning (OSP) is closed down. It had been established in 1984 (see Early 1984) to evaluate and address the vulnerabilities of Port Authority facilities, including the World Trade Center, to terrorist attacks. [Village Voice, 1/5/2000; New York County Supreme Court, 1/20/2004] The reasons for the closure are unknown. However, Peter Goldmark, who’d created the OSP, had resigned as executive director of the Port Authority in 1985 to take a new job. [Glanz and Lipton, 2004, pp. 226-228] So the absence of his support for the office may have been a factor.
During the hearings on the Iran-Contra affair, Representative Jack Brooks (D-TX) puts a question to National Security Council officer Colonel Oliver North about a secret plan he has developed to suspend the constitution and intern people in the event of an emergency (see 1982-1984). Referring to a recent article in the Miami Herald, he asks: “Colonel North, in your work at the NSC, were you not assigned at one time to work on plans for the continuity of government in the event of a major disaster.” However, Senator Daniel Inouye (D-H), chairman of the Senate Select Committee on Iran-Contra, immediately cuts Brooks off, saying, “I believe that question touches upon a highly sensitive and classified area, so may I request that you not touch upon that, sir.” Brooks pushes for an answer, saying: “I read in Miami papers and several others that there had been a plan by that same agency [FEMA]… that would suspend the American Constitution. I was deeply concerned about that and wondered if that was the area in which he [North] had worked.” Nevertheless, no answer is allowed to be given. [US Congress, 1987; Radar, 5/2008]
Longtime US Army intelligence officer Tom Golden, who is currently acting as a watchdog within the ultra-secretive Continuity of Government (COG) program (see January 1984), notifies the Army Inspector General’s Office of several instances of waste, fraud, and abuse within the highly classified COG project. Golden additionally speaks in confidence about his findings to the chief of the inspector general’s intelligence oversight division, Colonel Ned Bacheldor. Golden tells the Inspector General’s Office that contracts are being awarded based on personal relationships among military officials and company employees. He says government personnel have rotating careers at contracted companies and some are being hired at excessive rates for limited work. Golden says the multi-billion dollar communication system at the heart of the COG program does not function properly and is costing exorbitant amounts of money to fix, and alleges the problems are being covered up by military officials (see Late 1985 and December 1990). Golden reports a high-ranking officer within the COG program, Brigadier General Eugene Renzi, who was awarded a multimillion-dollar no-bid contract to the BETAC Corporation, which employed the general’s son. US News and World Report describes BETAC as a “consulting firm composed of former intelligence and communications specialists from the Pentagon.” Golden also notes the BETAC contract included $400-a-day consultant jobs for several COG officials, including one of Renzi’s aides. As a result of Golden’s report, two contracts will be found to be illegal and will be subsequently canceled. Renzi will also be reprimanded. The Army assures Golden his name will remain confidential, but his status as a whistleblower will be leaked weeks later by Bacheldor, who will soon leave the Inspector General’s Office to join the COG program. Golden will soon become the target of a retaliatory smear campaign led by members of the secret project, including Renzi and Bacheldor (see After July 1987). The effort to discredit Golden is organized by members of the secret COG project in retaliation for the whistleblower reporting instances of waste, fraud, and abuse to the Army Inspector General’s Office (see July 1987). Federal agents go door-to-door telling Golden’s neighbors they are investigating him for drinking and other embarrassing personal behaviors. Rumors are spread within the government about Golden having personal issues and spying for the Soviet Union. Those responsible for spreading the allegations include Brigadier General Eugene Renzi, who was exposed by Golden for awarding a no-bid contract to a company that employed the general’s son (see July 1987); Army intelligence officer Robert Rendon, an admitted black-marketer hired by the COG project in 1983 (see July 28, 1983); and Army Colonel Ned Bacheldor, who formally worked for the Army Inspector General’s Office and leaked Golden’s whistleblower status to members of the COG program. Rendon is ordered by his superior, Bacheldor, to spread insulting gossip about Golden. A classified document depicting Golden as a security risk is drawn up by Rendon and other members of the COG project and sent to the Justice Department in January 1990, leading to an official investigation of Golden’s background (see January-November 1990). In August 1990, Rendon insinuates to a fellow Army officer that Golden is a Soviet spy (see August 1990). “It leads people to believe you are in trouble,” Golden tells CNN in 1991, “and it damages your credibility, it damages your standing in the intelligence community, it really boils down to a smear campaign.” Separate investigations by the Army (see Summer 1987), the House Armed Services Committee (see Summer 1988-1989), and the FBI (see January-November 1990) conclude that Golden is guilty of no wrongdoing and is the target of a lengthy effort to intimidate whistleblowers inside the highly secretive COG program. “It cost myself and my family three years of living in absolute hell,” Golden says as he tears up during an interview with CNN, “my family paid a high price.” When asked if he would do it all over again, Golden nods and says, “Probably.” [Philadelphia Inquirer, 12/16/1990; Knight Ridder, 12/18/1990; CNN Special Assignment, 11/17/1991]

Boggs allegedly notifies Westerman that refusal will result in termination of his company’s contract with the government, while Lorenz reportedly threatens to put Westerman’s company out of business. Westerman refuses to turn over the records, and, according to Westerman, FEMA will burglarize his offices in search of the files (see Late 1987). Systems Evaluations’ contract with the government will be canceled shortly thereafter (see December 1987). Westerman will file a lawsuit against the government (see November 1988), but it will be frozen when the Justice Department opens an investigation of him (see November 1988) and will later be sealed after an in-depth report highlighting Westerman’s case is published by a major magazine (see August 8, 1989). Golden was removed from his position shortly after speaking to Army investigators and has since been targeted by members of the COG program for further retaliation (see After July 1987). Attempts by the committee to investigate claims of retaliation against Golden are thwarted by the secrecy of the program. Most of the congressmen lack the necessary security clearances to hear testimony on the COG project. Still, in a classified 1989 report, the House Armed Services Committee will conclude that Golden is the target of a lengthy and deliberate smear campaign. The Army Inspector General’s Office has reached a similar conclusion (see Summer 1987), as will the Justice Department (see January-November 1990). Despite the findings, the effort to discredit Golden will continue for years (see August 1990). During the investigation, the Congressional committee learns enough to fear for Golden’s safety and urges the Army to transfer him to Huntsville, Alabama, which it does. US Representative Lester Aspin (D-WI), chairman of the House Armed Services Committee, sends a letter to Army Secretary John Marsh criticizing the Army Inspector General’s Office for failing to keep the identity of a key whistleblower confidential and for botching an investigation into corruption within the highly secretive Continuity of Government (COG) program (see Summer 1987). The House Armed Services Committee is currently investigating the case of Army intelligence officer Tom Golden, who was retaliated against after revealing to Army investigators several instances of waste, fraud, and abuse within the COG unit stationed at Fort Hauchuca, Arizona (see July 1987 and After July 1987). Aspin expresses “concern about the objectivity and competence of the investigation,” noting that “confidentiality was breached almost immediately by the head of the inspector general inspection team,” referring to Colonel Ned Bacheldor, formally the chief of the inspector general’s intelligence oversight division, who spoke with Golden personally and later leaked his identity to the very officers Golden had implicated. Bacheldor left the inspector general’s office midway through the investigation of Golden’s case to join the COG unit at Fort Hauchuca. Aspin’s committee will conclude that Golden is the victim of a retaliatory smear campign led in part by Bacheldor. President Ronald Reagan signs a directive that details the US government’s plan for dealing with national emergencies, including a nuclear attack against the country. Executive Order 12656, “Assignment of Emergency Preparedness Responsibilities,” sets out the specific responsibilities of federal departments and agencies in national security emergencies. [US President, 11/18/1988] It deals with the nation’s Continuity of Government (COG) plan, which would ensure the federal government continued to function should such an emergency occur. [Washington Post, 3/1/2002; Atlantic Monthly, 3/2004] The order states, “The policy of the United States is to have sufficient capabilities at all levels of government to meet essential defense and civilian needs during any national security emergency.” It defines a “national security emergency” as “any occurrence, including natural disaster, military attack, technological emergency, or other emergency, that seriously degrades or seriously threatens the national security of the United States.” The order directs the head of every federal department and agency to “ensure the continuity of essential functions” during such an emergency by, among other things, “providing for succession to office and emergency delegation of authority.” According to Executive Order 12656, the National Security Council is “the principal forum for consideration of national security emergency preparedness policy,” and the director of the Federal Emergency Management Agency (FEMA) is to “assist in the implementation of national security emergency preparedness policy by coordinating with the other federal departments and agencies and with State and local governments.” [US President, 11/18/1988] The COG plan this directive deals with will be activated for the first time on 9/11, in response to the terrorist attacks that day (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001). [Washington Post, 3/1/2002; ABC News, 4/25/2004] Author Peter Dale Scott will later comment that, by applying the COG plan to “any national security emergency,” Executive Order 12656 means that the attacks of 9/11 will meet the requirements for the plan to be put into action. [Scott, 2007, pp. 185-186] In fact, a presidential directive in 1998 will update the COG plan specifically to deal with the threat posed by terrorists (see Early 1998 and October 21, 1998). President Ronald Reagan signs Executive Order 12656, assigning a wide range of emergency responsibilities to a number of executive departments. The order calls for establishing emergency procedures that go far beyond the nation’s standard disaster relief plans. It offers a rare glimpse of the government’s plans for maintaining “continuity of government” in times of extreme national emergency. The order declares the national security of the country to be “dependent upon our ability to assure continuity of government, at every level, in any national security emergency situation,” which is defined as “any occurrence, including natural disaster, military attack, technological emergency, or other emergency, that seriously degrades or seriously threatens the national security of the United States.” The order instructs department leaders to establish various protocols for crisis situations, including rules for delegating authorities to emergency officials, establishing emergency operating facilities, protecting and allocating the nation’s essential resources, and managing terrorist attacks and civil disturbances. The plans are to be coordinated and managed by the National Security Council and the Federal Emergency Management Agency (FEMA). The presidential order suggests certain laws may have to be altered or expanded to carry out the plans. Although it encourages federal agencies to base the emergency protocols on “existing authorities, organizations, resources, and systems,” it also calls on government leaders to identify “areas where additional legal authorities may be needed to assist management and, consistent with applicable executive orders, take appropriate measures toward acquiring those authorities.” According to the executive order, the plans “will be designed and developed to provide maximum flexibility to the president.” Executive Order 12656 gives specific instructions to numerous federal departments:
The Department of Justice is ordered to coordinate emergency “domestic law enforcement activities” and plan for situations “beyond the capabilities of state and local agencies.” The Justice Department is to establish plans for responding to “civil disturbances” and “terrorism incidents” within the US that “may result in a national security emergency or that occur during such an emergency.” The attorney general is to establish emergency “plans and procedures for the custody and protection of prisoners and the use of Federal penal and correctional institutions and resources.” The Department of Justice is also instructed to develop “national security emergency plans for regulation of immigration, regulation of nationals of enemy countries, and plans to implement laws for the control of persons entering or leaving the United States.” The attorney general is additionally instructed to assist the “heads of federal departments and agencies, state and local governments, and the private sector in the development of plans to physically protect essential resources and facilities.”
The Department of Defense, acting through the Army, is to develop “overall plans for the management, control, and allocation of all usable waters from all sources within the jurisdiction of the United States.” The secretary of defense is to arrange, “through agreements with the heads of other federal departments and agencies, for the transfer of certain federal resources to the jurisdiction and/or operational control of the Department of Defense in national security emergencies.” The secretary of defense is also instructed to work with industry, government, and the private sector, to ensure “reliable capabilities for the rapid increase of defense production.”
The Department of Commerce is ordered to develop “control systems for priorities, allocation, production, and distribution of materials and other resources that will be available to support both national defense and essential civilian programs.” The secretary of commerce is instructed to cooperate with the secretary of defense to “perform industry analyses to assess capabilities of the commercial industrial base to support the national defense, and develop policy alternatives to improve the international competitiveness of specific domestic industries and their abilities to meet defense program needs.” The Commerce Department is also instructed to develop plans to “regulate and control exports and imports in national security emergencies.”
The Department of Agriculture is ordered to create plans to “provide for the continuation of agricultural production, food processing, storage, and distribution through the wholesale level in national security emergencies, and to provide for the domestic distribution of seed, feed, fertilizer, and farm equipment to agricultural producers.” The secretary of agriculture is also instructed to “assist the secretary of defense in formulating and carrying out plans for stockpiling strategic and critical agricultural materials.”
The Department of Labor is ordered to develop plans to “ensure effective use of civilian workforce resources during national security emergencies.” The Labor Department is to support “planning by the secretary of defense and the private sector for the provision of human resources to critical defense industries.” The Selective Service System is ordered to develop plans to “provide by induction, as authorized by law, personnel that would be required by the armed forces during national security emergencies.” The agency is also vaguely instructed to establish plans for “implementing an alternative service program.”
The Transportation Department is to create emergency plans to manage and control “civil transportation resources and systems, including privately owned automobiles, urban mass transit, intermodal transportation systems, the National Railroad Passenger Corporation, and the St. Lawrence Seaway Development Corporation.” The Transportation Department is also to establish plans for a “smooth transition” of the Coast Guard to the Navy during a national security emergency. The Transportation Department is additionally instructed to establish plans for “emergency management and control of the National Airspace System, including provision of war risk insurance and for transfer of the Federal Aviation Administration, in the event of war, to the Department of Defense.”
The Department of the Treasury is ordered to develop plans to “maintain stable economic conditions and a market economy during national security emergencies.” The Treasury Department is to provide for the “preservation of, and facilitate emergency operations of, public and private financial institution systems, and provide for their restoration during or after national security emergencies.”
The Department of Energy is to identify “energy facilities essential to the mobilization, deployment, and sustainment of resources to support the national security and national welfare, and develop energy supply and demand strategies to ensure continued provision of minimum essential services in national security emergencies.”
The Department of Health and Human Services is instructed to develop programs to “reduce or eliminate adverse health and mental health effects produced by hazardous agents (biological, chemical, or radiological), and, in coordination with appropriate federal agencies, develop programs to minimize property and environmental damage associated with national security emergencies.” The health secretary is also to assist state and local governments in the “provision of emergency human services, including lodging, feeding, clothing, registration and inquiry, social services, family reunification, and mortuary services and interment.” [US President, 11/18/1988]

The storm causes billions of dollars in damage, displaces tens of thousands, and leaves hundreds of thousands jobless and without power. After the storm passes, FEMA is slow to take action. The first FEMA relief office opens a full week after the storm hits. Once the agency moves in, red tape, minimal resources, and poor management bog down the relief efforts. Senator Ernest Hollings (D-SC) bluntly describes FEMA’s hierarchy as a “bunch of bureaucratic jackasses” that should just “get the hell out of the way.” Charleston Mayor Joseph P. Riley Jr. criticizes FEMA for not bringing enough people or resources to his city. The relief system established by FEMA, he says, “is not designed to cope immediately and urgently with a major disaster.” Robert Hoffman, the mayor of St. Stephen in Berkeley County, says: “I really had more faith in our government.… We’re in serious trouble if FEMA is going to be the [lead] organization in the event of a nuclear war.” Unbeknownst to most of the public and government, the majority of the disaster agency is preoccupied with developing plans for a nuclear doomsday as part of the highly classified Continuity of Government program (see April 1, 1979-Present).
