In late December 1999, Rita Katz, working with the Investigative Project on Terrorism, gave a presentation in the White House to members of the National Security Council (NSC) about a suspected al-Qaeda sleeper cell based in Anaheim, California (see December 25, 1999). The NSC forwarded the information her team gleaned from public sources to the FBI. Katz later repeatedly asked a contact she had with the NSC named Peter what happened to the lead she gave them. Peter replied that he assumed the FBI was just sitting on the material. [Katz, 2003, pp. 180] Around January 2002, Katz is contacted by an FBI agent in California who is looking for investigative leads on al-Qaeda in California. Katz forwards him all her information she gave in her White House presentation back in 1999. According to Katz, the agent looks over the material and says it is “very strong… I want to go all the way with this investigation.” Then the agent registers his investigation with the FBI so other agents with leads could contact him. A few days later, he calls Katz and says that he has been taken off the case because it falls into the jurisdiction of the FBI’s Anaheim office. Apparently that office does nothing with the lead. In 1999, Katz suggested the cell included Khalil Deek, arrested in late 1999 for involvement in a millennium bomb plot in Jordan (see December 11, 1999), his brother Tawfiq Deek, Hisham Diab, and Khalid Ashour. [Katz, 2003, pp. 186-187] ABC News will later report that Diab continued to live in Anaheim until June 2001, when he apparently moved to Afghanistan to stay with top al-Qaeda leaders. [ABC News, 12/23/2004] Khalil Deek is mysteriously released in Jordan around the same time (see May 2001); it will later be alleged that he was a mole for the Jordanian government (see Shortly After December 11, 1999). By late 1999, Ashour had requested asylum in the US. Katz will later note that he “could have been easily located, investigated, and if necessary, denied asylum and deported.” But as of 2003, Katz claims Ashour still lives in the US. [Katz, 2003, pp. 187] Tawfiq Deek apparently continues to live in Anaheim as well, where he works for the state’s Department of Toxic Substance Control as a chemical engineer. He denies all terrorism ties, though he confirms that he was an active member of the Islamic Association for Palestine (IAP), which the FBI has called a Hamas front group. [LA Weekly, 9/15/2005] Another associate of the above group, Adam Gadahn, will emerge in Afghanistan in 2004 as a prominent al-Qaeda spokesman (see Spring 2004).
The US State Department asks the government of Brazil to remove Jose Bustani from his position as director-general of the Organization for the Prohibition of Chemical Weapons (OPCW), because the US is uncomfortable with his “management style” and his plan to convince Iraq to join the OPCW (see Between January 20, 2001 and June 2001). Brazil refuses. George Monbiot of the Guardian will note that the request is in violation of the chemical weapons convention, which states: “The director-general… shall not seek or receive instructions from any government.” [Guardian, 4/16/2002]
In 2005, Sen. John D. Rockefeller (D-WV) will claim in an interview, “I took a trip by myself in January of 2002 to Saudi Arabia, Jordan, and Syria, and I told each of the heads of state that it was my view that [President] George Bush had already made up his mind to go to war against Iraq, that that was a predetermined set course which had taken shape shortly after 9/11.” Rockefeller is Vice Chairman of the Senate Intelligence Committee at the time of his trip. [Fox News, 11/14/2005] Interestingly, CIA Director George Tenet gives the same warning to the president of Egypt in the same month (see January 16, 2002).
Deputy Secretary of Defense Paul Wolfowitz orders the CIA to conduct an investigation of Hans Blix, chairman of the new UN weapons inspection team (UNMOVIC) that will go to Iraq if Saddam Hussein agrees to re-admit the weapons inspectors. Wolfowitz feels that past investigations of Saddam’s declared nuclear power plants under the authority of Hans Blix were not sufficiently aggressive. The CIA reports back in late January that Blix conducted his past investigations “fully within the parameters he could operate” as chief of the agency. There are two opposing accounts of how Wolfowitz responds to the report’s conclusion. According to an anonymous former State Department official, Wolfowitz “hit the ceiling” upon learning the results because it did not provide a pretext for undermining Blix and UNMOVIC. However an administration official disputes this, claiming that he “did not angrily respond.” [Washington Post, 4/15/2002; Guardian, 4/23/2002; Independent, 5/10/2002] The Washington Post notes, “[T]he request for a CIA investigation underscored the degree of concern by Wolfowitz and his civilian colleagues in the Pentagon that new inspections—or protracted negotiations over them—could torpedo their plans for military action to remove Hussein from power” and ultimately lead to the suspension of sanctions. [Washington Post, 4/15/2002]
Steven Hatfill, later to emerge as a suspect of the anthrax attacks, is interviewed by FBI investigators for the first time. He is then given a lie-detector test as part of a wide-ranging FBI review of the scientific community. Hatfill is later told he gave satisfactory answers on the test. The FBI returns for a two-hour interview in March. [Washington Post, 8/11/2002]
The FBI finally begins subpoenaing laboratories that worked with the Ames strain of anthrax used in the attacks. But when the labs start to send their samples, they are told to wait another month because a new storage room for the sample needs to be built. The Hartford Courant reports, “The FBI’s delay in requesting the samples - and the government’s lack of readiness to receive them - is part of a pattern.” Other examples include taking seven months to begin testing mailboxes surrounding Princeton, New Jersey, where the anthrax letters were postmarked (see December 2001-Early August 2002), and nearly a year to go back into the American Media building in Boca Raton, Florida, to hunt for the source of anthrax that killed the first victim there. [Hartford Courant, 9/7/2002]
Deputy Secretary of Defense Paul Wolfowitz proposes that President Bush should declare Ramzi Yousef an “enemy combatant.” Yousef is already in the “Supermax” prison, the most secure prison in the US, after being sentenced to life in prison for the 1993 World Trade Center bombing years before. But Wolfowitz contends that as an enemy combatant, heavy interrogation could get Yousef to admit he bombed the WTC on behalf of the Iraqi government. However, Wolfowitz’s proposal is strongly opposed by the FBI, which asserts that theories tying Yousef to the Iraqi government had been repeatedly investigated and debunked. Further, Yousef doesn’t meet any of the criteria the White House had laid out for designating enemy combatants. “At one point, the high-level discussions apparently prompted a top Bureau of Prisons official to make an unauthorized entry to Yousef’s [Supermax cell] to sound out his willingness to talk—a move that prompted strong protests to the Justice Department from the bomber’s lawyer…” The issue is debated until the start of the Iraq war, at which point apparently Wolfowitz loses interest. One lawyer involved in the discussions will later recall, “We talked it to death.” [Newsweek, 4/21/2004]
In November 2001, US police called Nabil al-Marabh one of their top five suspects in the 9/11 attacks. [Toronto Sun, 11/23/2001] In mid-January 2002, Canadian police call him “the real thing.” [Toronto Sun, 11/23/2001] In late January 2002, it is reported that in Chicago, “Federal agents say criminal charges spelling out his role [in 9/11 and other plots] are likely within a few weeks.” [ABC News 7 (Chicago), 1/31/2002] Yet, shortly after this, there seems to be a dramatic change of opinion at Justice Department headquarters about al-Marabh. US Attorney Patrick Fitzgerald in Chicago drafts an indictment against Nabil al-Marabh, charging him with multiple counts of making false statements in his interviews with FBI agents. Fitzgerald already has several successful al-Qaeda prosecutions. However, the indictments are rejected by Justice Department headquarters in the name of protecting intelligence. In December 2002, Fitzgerald tracks down a Jordanian informant who had spent time with al-Marabh in a federal detention cell earlier in the year because of minor immigration problems. Fitzgerald has the man flown to Chicago and oversees his debriefing. The man reveals numerous criminal acts that al-Marabh confessed to him in prison, and the information fits with what is already known of al-Marabh’s history (see December 2002). However, Fitzgerald is still not allowed to indict al-Marabh. Another prosecutor in Detroit, trying some associates of al-Marabh in an ultimately unsuccessful case there, also expresses a desire to indict al-Marabh, but is not allowed to do so (see Early 2003). [Associated Press, 6/3/2004] Al-Marabh will ultimately be deported to Syria after serving a short sentence on minor charges (see January 2004).
Two psychologists, James Mitchell and Bruce Jessen, draft a paper on the use of harsh interrogations to break suspected al-Qaeda terrorists. Mitchell, a retired Air Force psychologist, and Jessen, the senior psychologist in charge of the Joint Personnel Recovery Agency (JPRA)‘s Survival, Evasion, Resistance, and Escape (SERE) training program, will soon begin consulting for both the Pentagon and a variety of US intelligence agencies on the harsh methods—torture—they advocate. Jessen proposes an interrogation program similar to those later adopted by the CIA and Pentagon. His proposal recommends creating what he calls an “exploitation facility,” off-limits to outside observers including journalists and representatives of the International Committee of the Red Cross, the agency detailed to ensure that captives in the custody of other nations are being treated properly in accordance with the Geneva Conventions. In the “exploitation facility,” interrogators would use such tactics as sleep deprivation, physical violence, and waterboarding to break the resistance of captured terrorism suspects. JPRA officials will later add their own suggestions to Jessen’s initial list, including sexually provocative acts by female interrogators and the use of military dogs. Most of these techniques are considered torture under the Geneva Conventions and the Convention Against Torture. [Washington Post, 4/22/2009]
At the request of CIA Director George Tenet, the White House orders the FBI to hand Ibn al-Shaykh al-Libi, a captured al-Qaeda operative being held in Afghanistan (see December 19, 2001), over to the CIA. One day before the transfer, a CIA officer enters al-Libi’s cell, interrupting an interrogation being conducted by FBI agent Russel Fincher, and tells al-Libi: “You’re going to Cairo, you know. Before you get there I’m going to find your mother and I’m going to f_ck her.” Soon after, al-Libi is flown to Egypt. [Newsweek, 6/21/2004; Washington Post, 6/27/2004; Isikoff and Corn, 2006, pp. 121] The CIA officer will later be identified as “Albert,” a former FBI translator. [Mayer, 2008, pp. 106] Presumably, this is the same former FBI translator named “Albert” who will later threaten al-Qaeda leader Abd al-Rahim al-Nashiri with a gun and drill during interrogations (see Between December 28, 2002 and January 1, 2003 and Late December 2002 or Early January 2003). [Associated Press, 9/7/2010] Vincent Cannistraro, former head of the CIA’s Counterterrorist Center, will later say: “He’s carried off to Egypt, who torture him. And we know that he’s going to be tortured. Anyone who’s worked on Egypt, has worked on other countries in the Middle East, knows that. Egyptians torture him, and he provides a lot of information.” [PBS Frontline, 6/20/2006]
Provides Mix of Valid, False Information - It is unclear whether al-Libi is interrogated solely by Egyptian officials, or by a combination of Egyptian and CIA interrogators. Al-Libi is subjected to a series of increasingly harsh techniques, including at least one, waterboarding, that is considered torture (see Mid-March 2002). Reputedly, he is finally broken after being waterboarded and then forced to stand naked in a cold cell overnight where he is repeatedly doused with cold water by his captors. Al-Libi is said to provide his Egyptian interrogators with valuable intelligence about an alleged plot to blow up the US Embassy in Yemen with a truck bomb, and the location of Abu Zubaida, who will be captured in March 2002 (see Mid-May 2002 and After). However, in order to avoid harsh treatment he will also provide false information to the Egyptians, alleging that Iraq trained al-Qaeda members in bomb making and poisons and gases. Officials will later determine that al-Libi has no knowledge of such training or weapons, and fabricates the statements out of fear and a desire to avoid further torture. Sources will later confirm that al-Libi did not try to deliberately mislead his captors; rather, he told them what he thought they wanted to hear. [ABC News, 11/18/2005; New York Times, 12/9/2005]
Using Allegations in White House Statements - Both President Bush (see October 7, 2002) and Secretary of State Colin Powell (see February 5, 2003) will include these allegations in major speeches.
Shifting Responsibility for Interrogations to CIA from FBI - The FBI has thus far taken the lead in interrogations of terrorist suspects, because its agents are the ones with most experience. The CIA’s apparent success with al-Libi contributes to the shift of interrogations from the bureau to the CIA. [Washington Post, 6/27/2004] Such methods as making death threats, advocated by the CIA, are opposed by the FBI, which is used to limiting its questioning techniques so the results from interrogations can be used in court. [Washington Post, 6/27/2004] “We don’t believe in coercion,” a senior FBI official says. [Guardian, 9/13/2004]

[Source: Public domain]Seven former Taliban leaders surrender to the Northern Alliance near Kandahar, Afghanistan, but are released. Two are on a US list of twelve most wanted Taliban leaders: Defense Minister Mullah Obaidullah Akhund and Justice Minister Mullah Nooruddin Turabi. Akhund “is considered by American intelligence officials to have been one of the Taliban leaders closest to Mr. bin Laden.” The US military denies reports of their release, but officials of the new Afghan government confirm the account and are unrepentant about it. They claim they are following through on an announced policy to grant amnesty to any Taliban leaders who surrender. CNN reports, “Though US forces expressed interest in the men,… they accepted the Afghan decision to let them go, and have given no indication they are pursuing them…” This follows other accounts of Taliban leaders being released in December 2001 (see December 24, 2001). A senior Pakistani official will later note, “Unbelievably, not one [Taliban cabinet minister] was killed, arrested, or defected to opposition forces during the two-month-long, nonstop bombing.” It appears that the highest ranking Taliban leader to have been killed or captured is the deputy foreign minister, who was killed in a bombing raid. [Washington Post, 12/17/2001; New York Times, 12/20/2001; Washington Post, 1/10/2002; CNN, 1/10/2002] Mullah Obaidullah Akhund will later become one of the most important leaders of the continued Taliban resistance. In 2004, it will be reported that Pakistan is allowing him and other Taliban leaders to freely come and go through Pakistan (see August 18, 2005). [Boston Globe, 7/11/2004]
Vice President Dick Cheney, sometimes accompanied by his chief of staff, Lewis “Scooter” Libby, visits the offices of US intelligence analysts working at CIA headquarters in Langley, Virginia “approximately 10” times. He interrogates them on their intelligence work on Iraq. Some analysts later complain that Cheney’s visits made them feel pressured to provide the administration with conclusions that supported the case for war. Other analysts will say they did not feel pressured. [Washington Post, 6/5/2003; Sydney Morning Herald, 6/5/2003; Guardian, 7/17/2003; Bamford, 2004, pp. 336; Vanity Fair, 5/2004, pp. 242] Michael Sulick, deputy chief of the CIA’s Directorate of Operations, will later recall, “It was like they were hoping we’d find something buried in the files or come back with a different answer.” As a result of these visits, Sulick believes that agency analysts became “overly eager to please.” [Isikoff and Corn, 2006, pp. 4-5] According to Ray McGovern, a 27-year veteran CIA analyst, these visits were “unprecedented.” [Common Dreams, 7/23/2003] In 2006, author Craig Unger will call the visits “a highly irregular occurrence.” Former CIA analyst Melvin Goodman will recall: “I was at the CIA for 24 years. The only time a vice president came to the CIA building was for a ceremony, to cut a ribbon, to stand on a stage, but not to harangue analysts about finished intelligence.… When they go, it’s usually for some ceremonial reason, to hand out an award or to cut a ribbon. Then they get the hell out.” Former DIA analyst Patrick Lang will say: “Many, many of them [CIA analysts] have told me they were pressured. And there are a lot of ways. Pressure takes a lot of forms.” A State Department official will note: “For the vice president to be meeting with analysts, that was a real red flag. It was so unusual. It was clear that people were being leaned on. Usually, if a high-ranking official wants information, it gets tasked out through appropriate channels. It was highly unusual to lock these people in a room and keep pressing. It crossed the line between… intellectual inquiry and not accepting the real answer.” Another intelligence source says: “[Cheney] wanted them to make a connection between Iraq and al-Qaeda. He already got them to agree on nuclear weapons. But he wanted the al-Qaeda connection.” Retired CIA officer Richard Kerr, brought back to the agency to study intelligence failures, later describes “overwhelming consumer demand” on agency analysts, which Kerr will say results in flawed intelligence reports. The pressure brought on analysts, another source says, is “brutal.” [Dubose and Bernstein, 2006, pp. 211; Unger, 2007, pp. 262-263] Former House Speaker Newt Gingrich (R-GA) also makes visits to CIA headquarters in Langley. [Guardian, 7/17/2003]
Walid al-Qadasi, a 22-year-old Yemeni, is captured in Iran and transferred to US custody, where he is soon transferred to an Afghan prison. Like another captive, Wisam Ahmed (see December 2001 and After), al-Qadasi calls the site the “Dark Prison.” (Civil rights activist Andy Worthington later writes that he believes Ahmed and al-Qadasi were kept at different sites.) Al-Qadasi will later recall: “The Americans interrogated us on our first night which we coined as ‘the black night.’ They cut our clothes with scissors, left us naked, and took photos of us before they gave us Afghan clothes to wear. They then handcuffed our hands behind our backs, blindfolded us, and started interrogating us.… They threatened me with death, accusing me of belonging to al-Qaeda.” After the initial interrogation, he recalls: “They put us in an underground cell measuring approximately two meters by three meters. There were 10 of us in the cell. We spent three months in the cell. There was no room for us to sleep so we had to alternate.… It was too hot in the cell, despite the fact that outside the temperature was freezing (there was snow), because the cell was overcrowded.” He will recall being fed only once a day, tormented by ear-splittingly loud music, and will say that one of his fellow detainees “went insane.” According to his later statement, when Red Cross representatives come to visit, the most severely disturbed prisoners are secretly moved to another cell that is off limits. Al-Qadasi will be transferred to Guantanamo, and in 2004 will be remanded into Yemeni custody. [Future of Freedom Foundation, 4/27/2009]
Allekema Lamari, one of about three of the 2004 Madrid train bombing masterminds, is released from a Spanish prison in 2002. The Spanish government will later call him the “emir” of the bombings. Most of the alleged Madrid bombers have little formal connection to any Islamist militant group or training camp, but Lamari has an extensive background as an Algerian militant. He was imprisoned in Spain in 1997 for belonging to the GIA militant group. When he is released from prison in 2002, an informant named Safwan Sabagh closely follows him. Sabagh travels with him, and moves towns at the same time Lamari does. Sabagh has a special assignment from the Spanish intelligence agency, the CNI, to focus on Lamari, since Lamari is considered such a dangerous character. Sabagh is considered an excellent informant and gives a steady stream of information about Lamari. For instance, on March 8, just three days before the Madrid bombings, Lamari calls Sabagh and appears nervous and concerned about something that has to happen soon. Sabagh is with Lamari when Lamari meets other masterminds of the plot, such as Serhane Abdelmajid Fakhet. Sabagh also introduces Lamari to Mohamed Afalah and vouches that he is a person Lamari can trust. [El Mundo (Madrid), 10/17/2005] Afalah becomes Lamari’s driver, bodyguard, and confidante, but Afalah also is an informant for the CNI. [El Mundo (Madrid), 1/15/2007] Furthermore, three other CNI informants, Abdelkader Farssaoui (alias Cartagena), Smail Latrech, and Rabia Gaya, also sometimes keep tabs on Lamari. Several weeks after the Madrid bombings, Sabagh will be arrested and held for one day, and then let go. It has not been explained how the CNI is unable to stop the Madrid bombings when possibly the most important mastermind of those bombings was surrounded by so many informants. The US wants al-Qaeda leader Hassan Ghul arrested, but the Pakistani government will not do so, apparently because he is part of a Pakistani militant group supported by the ISI, Pakistan’s intelligence agency. Details and timing are vague, but US intelligence becomes increasingly interested in Ghul. He is believed to be part of al-Qaeda leader Abu Zubaida’s secret network of moneymen and couriers. According to a 2011 article by the Associated Press, the CIA has been pressing the Pakistani government to arrest Ghul “for years.” After 9/11, Ghul hides in Lahore, Pakistan, in safe houses run by the Pakistani militant group Lashkar-e-Toiba (LeT). This group helps many al-Qaeda operatives escape Afghanistan and hide in Pakistan after 9/11, and it even helps Zubaida escape and hide (see Late 2001-Early 2002). However, the ISI refuses to arrest Ghul. The Associated Press will report that “former CIA officers who targeted Ghul said he had ties to the Lashkar-e-Toiba terror group, which had the backing of the ISI.” Eventually, the CIA learns that Ghul plans to meet with al-Qaeda operatives fighting against US forces in Iraq. Ghul is captured in Iraq on January 23, 2004 (see January 23, 2004). However, the Pakistani government is said to be furious that Ghul has been captured, and the US is pressed to return him. The US transfers him to a secret CIA prison instead. [Associated Press, 6/15/2011]
Some of the weapons found aboard the ‘Karine A.’ [Source: Associated Press / BBC]Israeli commandos seize a freighter, the “Karine A” (or “Karin A”), in the Red Sea 300 miles off the coast of Israel, in an operation dubbed “Operation Noah’s Ark.” Eli Marum, an Israeli Navy operations chief, says the operation took less than eight minutes and did not require a single shot being fired. “The crew was fully surprised,” he says. “They did not anticipate that we would strike so far out into the Red Sea.” Israeli officials claim the freighter contains a large store of Iranian-supplied weapons—including Katyusha rockets capable of destroying tanks, mortars, grenades, Kalashnikov assault rifles, anti-tank missiles, high explosives, and two speedboats—for use by Palestinian fighters against Israeli targets. The Palestinian Authority is forbidden by treaty to own such weaponry. Israel also claims that the captain of the freighter, Omar Akawi, has direct ties to the Palestinian Authority and to its leader, Yasser Arafat. (According to Israeli sources, Akawi claims he is a member of Arafat’s organization Fatah.) Defense Minister Binyamin Ben-Eliezer tells European Union (EU) authorities that the freighter “was purchased by the Palestinian Authority after September 11” and that “the whole operation was managed and funded by the Palestinian Authority in cooperation with Iran and other sources.” [BBC, 1/10/2002; Guardian, 1/21/2002; Jewish Virtual Library, 2009] “What Iran is trying to do is create another base, besides its base in Lebanon” to threaten Israel, says Major General Giora Eiland, the Israeli Army’s chief of planning. [New York Times, 1/12/2002]
Arafat's Denials - Initially, Arafat denies any connection whatsoever with the shipment, accusing Israel of fomenting a propaganda attack to thwart US-led efforts to implement a cease-fire agreement, and says Israel “fabricated” the whole affair. Ahmed Abdel Rahman, the secretary general of the Palestinian cabinet, calls the operation “an Israeli trap.” Later, Arafat continues to insist that he had no involvement in the affair, but admits that he cannot control “everyone” in the Palestinian Authority. American and Israeli intelligence officials note that the weaponry on board the “Karine A” is similar to that of a “wish list” allegedly drawn up by senior Palestinian officials under Arafat’s direction. Propaganda by Israel? - Some, such as Guardian reporter Brian Whitaker, believe that Israel is using the incident to persuade the EU to stop funding the Palestinian Authority. And, Whitaker notes, Israeli lawmakers and pundits such as former President Benjamin Netanyahu are using the incident to argue that the idea of Palestinian statehood be permanently scrapped. Whatever the truth of the matter, the attempts suffer setbacks when documents show that an Iraqi, Ali Mohamed Abbas, purchased the ship, and other records disprove the Israelis’ claims about the ship’s cargo, which Israel says it picked up in Yemen. It seems clear that the freighter was indeed carrying weapons, but little of Israel’s other claims—they were Iranian in origin and intended for Palestinian use against Israel—are borne out by ascertainable facts.
Hezbollah Connection? - American intelligence sources later speculate that the weapons may have been intended for Hezbollah, the Lebanese Shi’ite militant organization with close ties to Iran, and not the Palestinians. Israel is initially resistant to the idea, but Israeli defense sources later tell Israeli reporters that it was “certainly possible that some of the arms were earmarked for Hizbullah,” though it is certain that most “were clearly bound for the Palestinian Authority.” Whitaker echoes skeptics’ disbelief about the Hezbollah claim, noting that there are easier and more secure methods of delivering arms to Lebanon than a risky sea voyage past Israeli patrol boats. [Guardian, 1/21/2002] Israel names reputed senior Hezbollah security officer Imad Mughniyeh as a key figure in the incident. Mughniyeh has not been heard from for years by Western intelligence, but is wanted by the FBI for his participation in kidnapping Americans in Beirut during the 1980s and the hijacking of a TWA passenger plane. The BBC reports, “Correspondents say the Israeli government has been going to great lengths to convince Washington that the Palestinian leader Yasser Arafat is linked to Tehran and the pro-Iranian Hezbollah, and hence to what it sees as international terrorism.” [BBC, 1/10/2002]
Iranian Connection Unlikely - And the Iranian connection is similarly hard to swallow. Though Israel insists that the arms prove a new and disturbing connection between Iran and Palestinian militants, Whitaker writes, “most non-Israeli observers of Iran ridicule the idea totally, for a variety of historical, political and religious reasons. It also conflicts with the foreign policies adopted by [Iranian] President [Mohamed] Khatami.” He goes on to add: “The trouble with Iran, though—as one Iranian exile remarked last week—is that it has two governments and 10,000 leaders. If you are going to pin blame, you have to determine which one is responsible.” Whitaker is referring to Iran’s religious and secular leaders, who are often at odds with one another, and to the propensity of Iranian leaders from both sides to conduct independent operations without “official” government sanction. [Guardian, 1/21/2002] The New York Times notes: “Iran’s government has dismissed the Israeli accusations. But Iran’s Revolutionary Guards have discretionary funds and access to weapons, and they often run operations independent of the elected government of… Khatami.” [New York Times, 1/12/2002] The “Karine A” incident helps prompt Bush officials to include Iran as a member of the so-called “axis of evil,” disrupting backchannel negotiations between Iranian and US officials (see January 29, 2002).

Mullah Mohammed Omar. [Source: CBC]The US allegedly locates former Taliban leader Mullah Omar and 1,500 of his soldiers in the remote village of Baghran, Afghanistan. After a six-day siege, and surrounded by US helicopters and troops, Omar and four bodyguards supposedly escape the dragnet in a daring chase on motorcycles over dirt roads. His soldiers are set free in return for giving up their weapons, in a deal brokered by local leaders. Yet it remains unclear if Omar was ever in the village in the first place. [Observer, 1/6/2002]
Military spokesperson Navy Rear Adm. John Stufflebeem says, “We’re going to stop chasing… the shadows of where we thought [bin Laden and Mullah Omar were] and focus more on the entire picture of the country, where these pockets of resistance are, what do the anti-Taliban forces need, so that we can develop a better intelligence picture. The job is not complete and those leaders whom we wish to have from the al-Qaeda and Taliban chain of command, we are casting a wide net—a worldwide net, as well as regional, for where they are.” This announcement comes just two days after reports that Mullah Omar escaped an encirclement near Kandahar and fled into the nearby hills (see January 6, 2002). The Justice Department’s Patrick Philbin sends a classified memo to Attorney General John Ashcroft. The memo’s contents will not be divulged, but the American Civil Liberties Union (ACLU) will later learn that it regards Ashcroft’s review of the Terrorist Surveillance Program (TSP—see March 2002). [American Civil Liberties Union [PDF], 1/28/2009 ] The memo contains a legal review by Ashcroft of President Bush’s order authorizing the TSP, the Bush administration’s name for its warrantless wiretapping program. The review is requested before one of the 45-day reauthorizations by the president as required by law. [ProPublica, 4/16/2009]

[Source: Public domain]Andreas von Bülow, former German Minister for Research and Technology and a long-time member of German parliament, suggests in an interview that the CIA could have been behind the 9/11 attacks. He states: “Whoever wants to understand the CIA’s methods, has to deal with its main task of covert operations: Below the level of war, and outside international law, foreign states are to be influenced by inciting insurrections or terrorist attacks, usually combined with drugs and weapons trade, and money laundering.… Since, however, it must not under any circumstances come out that there is an intelligence agency behind it, all traces are erased, with tremendous deployment of resources. I have the impression that this kind of intelligence agency spends 90 percent of its time this way: creating false leads. So that if anyone suspects the collaboration of the agencies, he is accused of paranoia. The truth often comes out only years later.” [Der Tagesspiegel (Berlin), 1/13/2002] In an example of covering tracks, Ephraim Halevy, head of Israel’s Mossad from 1998 until 2002, claims, “Not one big success of the Mossad has ever been made public” (see February 5, 2003). On January 12, 2002, Pakistani President Pervez Musharraf gives a speech denouncing violent Islamist militancy for the first time. He is essentially forced to give the speech after militants supported by Pakistan launched attacks in the disputed region of Kashmir, bringing India and Pakistan close to the brink of nuclear war. He also bans five militant groups (see January 12, 2002). [Rashid, 2008, pp. 116-118] Shortly after the speech, Pakistan arrests about 3,000 suspected militants. Musharraf is hailed in the Western media as redirecting the ISI to support the US agenda. But by the end of the month, at least 800 of the arrested are set free, including most of their leaders. Not a single one of the arrested militants is charged with any terrorist offense. [Washington Post, 3/28/2002; Time, 5/6/2002; Rashid, 2008, pp. 155] A US diplomat based in Pakistan will later say: “By March it was clear to us that Musharraf was not going to implement his promises [given in the speech]. All the arrested militants were freed, and the military had no intention of imposing any curbs on their activities.” The US State Department attempts to pressure Musharraf to keep the promises he made in the speech. However, Defense Secretary Donald Rumsfeld and the US Defense Department is reluctant to pressure him, fearing that Pakistan will stop cooperating in capturing al-Qaeda leaders. Rumsfeld is apparently not concerned by the strong links between Pakistani militant groups and al-Qaeda. [Rashid, 2008, pp. 118] Within one year, “almost all” of those arrested have been quietly released. Even the most prominent leaders, such as Maulana Masood Azhar, have been released. Their banned militant organizations are running again, most under new names. [Washington Post, 2/8/2003]
According to former CIA officer Robert Baer, a high-ranking CIA official tells a reporter off-the-record that, “when the dust finally clears, Americans will see that September 11 was a triumph for the intelligence community, not a failure.” It is unclear why the CIA officer thinks this and the reporter who tells Baer this story is not named. However, Baer comments that if that is what the CIA thinks, “I’m scared to death of what lies ahead.” [Baer, 2002, pp. xxiii]

[Source: Associated Press]Vice Admiral John Poindexter begins running a shadowy new government agency called the Information Awareness Office. [New York Times, 2/13/2002; Federal Computer Week, 10/17/2002] Poindexter, formerly President Reagan’s National Security Adviser, is known for his five felony convictions of lying to Congress, destroying documents, and obstructing Congress in its investigation of his role in the mid-1980s Iran-Contra affair. Later his convictions were overturned on a technicality. [Los Angeles Times, 11/17/2002] Far from apologizing, Poindexter said it was his duty to lie to Congress. [Newsday, 12/1/2002] The New York Times notes that his new agency “is developing technologies to give federal officials instant access to vast new surveillance and information-analysis systems.” The new office is part of DARPA, the Defense Advanced Research Projects Agency. Poindexter was also known for his controversial role in shifting control of computer security to the military in the 1980s. Says Marc Rotenberg, former counsel for the Senate Judiciary Committee, “It took three administrations and both political parties over a decade to correct those mistakes.” [New York Times, 2/13/2002] Surprisingly, Poindexter’s appointment is little noticed until later in 2002 when the Total Information Awareness program is revealed (see March 2002; November 9, 2002). Incidentally, several others involved in the Iran-Contra affair also find jobs in the Bush Administration, including Elliott Abrams, John Negroponte, and Otto Reich. [Observer, 12/8/2002]
Two analysts in CIA’s WINPAC division review the Niger documents and notice some inconsistencies. But as they later explain to congressional investigators, they don’t see anything “jumping out at [them] that the documents [are] forgeries.” [Isikoff and Corn, 2006, pp. 164] By this time, at least three other US intelligence analysts, and one Italian journalist have reviewed the documents and raised questions about their authenticity (see Afternoon October 7, 2002, October 9, 2002, October 15, 2002, and Mid-October 2002).
After more than two months and more than 350 inspections, the UN teams have failed to find the arsenal of banned weapons the US and Britain claim Iraq has. Nor are there any signs of programs to build such weapons. The London Observer reports that International Atomic Energy Agency (IAEA) inspectors are convinced Iraq does not have a reconstituted nuclear weapons program. “IAEA officials and intelligence sources admit it is extremely unlikely that Iraq has nuclear weapons squirreled away,” The Observer reports, explaining that “… the IAEA [had] revealed that analysis of samples taken by UN nuclear inspectors in Iraq… showed no evidence of prohibited nuclear activity.” [Observer, 1/26/2003; Los Angeles Times, 1/26/2003; Washington Post, 12/27/2003]
By this time, more than 300 different inspections have been conducted in Iraq by the UN weapons inspection teams, which report no instances of Iraqi attempts to impede their access to the alleged weapons sites. [Associated Press, 1/18/2003; Baltimore Sun, 1/20/2003; New York Times, 1/20/2003] The London Independent quotes one diplomat, who says, “Realistically, it is not going to be easy to see in the next two months that we will be able to say that Iraq is not cooperating.” [Independent, 1/8/2003] Inspectors also say that there are no signs that Iraq is developing weapons of mass destruction. An Associated Press report cites several specific cases of alleged weapons sites that the inspection teams—after repeated visits—have determined are not involved in the production of weapons of mass destruction. “UN arms monitors have inspected 13 sites identified by US and British intelligence agencies as major ‘facilities of concern,’ and reported no signs of revived weapons building.” [Associated Press, 1/18/2003; Baltimore Sun, 1/20/2003; New York Times, 1/20/2003] And International Atomic Energy Agency (IAEA) Chief Weapons Inspector Mohamed ElBaradei tells reporters: “I think it’s difficult for Iraq to hide a complete nuclear-weapons program. They might be hiding some computer studies or R. and D. on one single centrifuge. These are not enough to make weapons”

CIA Director George Tenet informs Egyptian President Hosni Mubarak during a meeting in the Egyptian resort of Sharm el Sheikh that the Bush administration has already decided to attack Iraq and asks Mubarak not to publicly express Egypt’s opposition to the planned invasion. The Egyptian president warns that an attack on Iraq could destabilize the entire Middle East. [Ha'aretz, 2/17/2002 Sources: Unnamed source interviewed by the Lebanese newspaper Al-Mustaqbal] A Democratic senator gives the same warning to the heads of state in Saudi Arabia, Jordan, and Syria in the same month (see January 2002).
Attorney General John Ashcroft warns that suicide attacks “might be expected because of confidential information” the US government has received. He further warns, in regards to the five most wanted terrorists, that “These men could be anywhere in the world” and “may be trained and prepared to commit future suicide terrorist acts.” [NBC, 1/17/2002]
Saber Lahmar. [Source: US Defense Department]The US renditions six suspects to Guantanamo, even though their cases are under appeal in Bosnia. On October 8, 2001, Bosnian police arrested Bensayah Belkacem, an Algerian given Bosnian citizenship and living in Bosnia. US intelligence intercepted numerous phone calls between Abu Zubaida and other al-Qaeda leaders and Belkacem (see October 8, 2001). On October 16, a conversation was overheard in which US and British targets in Bosnia are mentioned, and a Bosnian associate of Belkacem’s named Saber Lahmar said to another associate, “Tomorrow we will start.” US and British embassies were shut down that night, and Lahmar and four associates - Al-Hajj Boudella, Lakhdar Boumediene, Mustafa Ait Idir, and Mohamed Nechle - were quickly arrested. Lahmar worked for the Saudi High Commission. In 1997 he was arrested and convicted of plotting to bomb the US embassy in Sarajevo, but then pardoned and released by the Bosnian government (see 1996 and After). Boudella was an elite al-Qaeda training camp trainer in Afghanistan and Bosnia, then worked at the Benevolence International Foundation, which the US declared a terrorism financier after 9/11 (see 1993). Belkacem’s other associates worked for other charities such as the Red Crescent society and Taibah International. [Time, 11/12/2001] On January 18, 2002, the Bosnian government determines they don’t have enough evidence to charge the six men since the US will not share details of its communications intercepts. A high court rules that the men are not allowed to be deported until their appeals are heard. [BBC, 1/22/2002] But the men are nonetheless released directly into the custody of US soldiers, who immediately fly them to the Guantanamo Bay prison. The handover is denounced as illegal by human rights groups. It is believed the US put intense pressure on Bosnia to hand them over. [BBC, 1/22/2002; New York Times, 1/23/2002] The Bosnian government, still not privy to the intercepts, will later clear them of all charges, but the US will continue to hold them in Guantanamo without revealing any of the evidence said to justify their detention. [Washington Post, 8/21/2006]
John Bellinger, the White House’s chief national security counsel, sends his supervisor, National Security Adviser Condoleezza Rice, what he thinks is a private memo with a blunt warning about the legality of the proposal to ignore the Geneva Conventions in interrogating terror suspects (see January 18-25, 2002). The proposal, Bellinger writes, will place Bush in direct breach of international law and threaten the most fundamental cooperation from allied governments. Faxes from other governments, even Britain, have been pouring into the State Department warning that they cannot turn over suspects to the US if the Bush administration withdraws from accepted legal norms. The Bellinger memo quickly finds its way into Vice President Cheney’s office, to Bellinger’s chagrin; Cheney is reportedly “concerned” about Belliger’s advice. Bellinger does not know until now that any documents prepared for Rice are always “routed outside the formal process” to Cheney. The reverse does not apply. Bellinger is unaware of just how systematically he is being cut out of the decision-making process. [Ledger (Lakeland FL), 10/24/2004; Washington Post, 6/24/2007]
In January 2002, the Observer reports that Anas al-Liby, one of al-Qaeda’s top leaders, has been recently captured in Afghanistan. Al-Liby is considered one of bin Laden’s computer experts, and a long-time member of al-Qaeda’s ruling council. [Observer, 1/20/2002] In early March 2002, the London Times mentions al-Liby’s capture as an established fact. [London Times, 3/11/2002] Then, in late March 2002, the London Times and the Washington Post report that al-Liby has been recently captured in Sudan. Anonymous CIA sources and anonymous “senior administration officials” claim that al-Liby has been captured, but the Sudanese and US governments officially deny the arrest. The London Times says the arrest “has been kept a closely guarded secret.” Some senior officials who told the Post al-Liby had been arrested later change their account and say it was someone with a similar name. [London Times, 3/17/2002; Washington Post, 3/19/2002; Washington Post, 3/20/2002] Al-Liby remains on the FBI’s most wanted list, with a $25 million reward on his name. It will later be lowered to $5 million. [London Times, 5/8/2005] Al-Liby appears to have collaborated with British intelligence to kill Libyan leader Colonel Mu’ammar al-Qadhafi in 1996 and was allowed to openly live in Britain until 2000 (see Late 1995-May 2000; 1996). In 2003, it will be reported that al-Liby was captured in Sudan and then secretly deported to Egypt, where he is wanted for an attempted assassination of Egyptian President Hosni Mubarak (see (Late 1995)). [Scotland on Sunday, 10/26/2003] In 2007, human rights groups will list al-Liby as a possible ghost prisoner still held by the US (see June 7, 2007).
Secretary of State Colin Powell asks for a meeting with President Bush, hoping to dissuade him from abandoning the Geneva Conventions in the interrogation procedures involving terror suspects (see January 18-25, 2002). Powell is unaware that he and the State Department have been deliberately cut out of the decision-making process by the Office of the Vice President.
Memo Released to Undermine Powell - Before Powell can meet with the president, White House counsel Alberto Gonzales releases a memo that paints Geneva as “quaint” (see January 25, 2002) to the administration, in an attempt to anticipate and undermine Powell’s objections. Following up on the argument that the Geneva Conventions are “quaint,” Vice President Cheney’s chief counsel, David Addington, portrays Powell as a defender of “obsolete” rules devised for an earlier time. If Bush follows Powell’s lead, Addington warns, US forces would be obliged to provide athletic gear and commissary privileges to captured terrorists. State Department lawyer David Bowker later says that Powell never argued that al-Qaeda and Taliban detainees deserve the full privileges of prisoners of war; while each captive deserves a status review under Geneva, he believes few will qualify because the suspects do not wear uniforms on the battlefield or obey a lawful chain of command. Bowker recalls, “We said, ‘If you give legal process and you follow the rules, you’re going to reach substantially the same result and the courts will defer to you.’” The upshot of Bush’s decision to go with Gonzales’s opinion over Powell’s has the effect of relegating the State Department to the sidelines. A senior administration official will later recall: “State was cut out of a lot of this activity from February of 2002 on. These were treaties that we were dealing with; they are meant to know about that.” State’s senior legal adviser, William H. Taft IV, is shunned by the lawyers who dominated the detainee policy, officials say; some Bush conservatives privately call Taft too “squishy and suspect” to adequately fight terrorists, according to a former White House official. “People did not take him very seriously.” [Ledger (Lakeland FL), 10/24/2004; Washington Post, 6/24/2007]
Memo Prompts Media Criticism of Powell - As Gonzales’s memo begins to circulate around the government, Addington says to White House lawyer Timothy Flanigan, “It’ll leak in 10 minutes.” He is correct: on January 26, the conservative Washington Times prints a front-page article that features administration sources accusing Powell of “bowing to pressure from the political left” and advocating that terrorists be given “all sorts of amenities, including exercise rooms and canteens.” The article implies that Powell is soft on the nation’s enemies. Addington blames the State Department for leaking the memo, and says that the leak proves Taft cannot be trusted. Taft later recalls, “I was off the team.” Addington had marked him as an enemy, Taft will recall, but Taft had no idea he was at war. “Which, of course, is why you’re ripe for the taking, isn’t it?” he adds. White House lawyer Alberto Gonzales completes a draft memorandum to the president advising him not to reconsider his decision (see January 18-25, 2002) declaring Taliban and al-Qaeda fighters ineligible for prisoner of war status as Colin Powell has apparently recommended. [US Department of Justice, 1/25/2004 ; Newsweek, 5/24/2004] The memo recommends that President Bush accept a recent Office of Legal Counsel (OLC) memo saying that the president has the authority to set aside the Geneva Conventions as the basis of his policy (see January 9, 2002). [Savage, 2007, pp. 146]
Geneva No Longer Applies, Says Gonzales - Gonzales writes to Bush that Powell “has asked that you conclude that GPW [Third Geneva Convention] does apply to both al-Qaeda and the Taliban. I understand, however, that he would agree that al-Qaeda and the Taliban fighters could be determined not to be prisoners of war (POWs) but only on a case-by-case basis following individual hearings before a military board.” Powell believes that US troops will be put at risk if the US renounces the Geneva Conventions in relation to the Taliban. Rumsfeld and his chairman of the Joint Chiefs of Staff, Gen. Richard B. Myers, allegedly agree with Powell’s argument. [New York Times, 10/24/2004] But Gonzales says that he agrees with the Justice Department’s Office of Legal Counsel, which has determined that the president had the authority to make this declaration on the premise that “the war against terrorism is a new kind of war” and “not the traditional clash between nations adhering to the laws of war that formed the backdrop for GPW [Geneva Convention on the treatment of prisoners of war].” Gonzales thus states, “In my judgment, this new paradigm renders obsolete Geneva’s strict limitations on questioning of enemy prisoners and renders quaint some of its provisions.” [Newsweek, 5/24/2004] Gonzales also says that by declaring the war in Afghanistan exempt from the Geneva Conventions, the president would “[s]ubstantially [reduce] the threat of domestic criminal prosecution under the War Crimes Act [of 1996]” (see August 21, 1996). The president and other officials in the administration would then be protected from any future “prosecutors and independent counsels who may in the future decide to pursue unwarranted charges.” [New York Times, 5/21/2004; Newsweek, 5/24/2004]
Memo Actually Written by Cheney's Lawyer - Though the memo is released under Gonzales’s signature, many inside the White House do not believe the memo was written by him; it has an unorthodox format and a subtly mocking tone that does not go with Gonzales’s usual style. A White House lawyer with direct knowledge of the memo later says it was written by Cheney’s chief lawyer, David Addington. Deputy White House counsel Timothy Flanigan passed it to Gonzales, who signed it as “my judgment” and sent it to Bush. Addington’s memo quotes Bush’s own words: “the war against terrorism is a new kind of war.” [Washington Post, 6/24/2007]
Powell 'Hits the Roof' over Memo - When Powell reads the memo (see January 26, 2002), he reportedly “hit[s] the roof” and immediately arranges for a meeting with the president (see January 25, 2002). [Newsweek, 5/24/2004]
US Secretary of State Colin Powell responds to Alberto Gonzales’ January 25 draft memo to the president (see January 25, 2002). He argues that it does not provide the president with a balanced view on the issue of whether or not to apply the Geneva Conventions to the conflict in Afghanistan. Powell lists several problems that could potentially result from exempting the conflict from the Conventions as Gonzales recommends. For example, he notes that it would “reverse over a century of US policy and practice in supporting the Geneva conventions and undermine the protections of the law of war for our troops, both in this specific conflict and in general.” The decision will furthermore have “a high cost in terms of negative international reaction.” It will “undermine public support among critical allies, making military cooperation more difficult to sustain,” and other states would “likely have legal problems with extradition or other forms of cooperation in law enforcement, including in bringing terrorists to justice.” But perhaps most ominously, Powell charges that the proposed decision “may provoke some individual foreign prosecutors to investigate and prosecute our officials and troops” and “make us more vulnerable to domestic and legal challenge.” The end of the memo consists of several rebuttals to points that Gonzales made in his memo. Three weeks after the “Karine A” is seized, allegedly filled with Iranian weapons destined to be used against Israel (see January 3, 2002 and After), President Bush names Iran as one of the world’s “axis of evil” nations (see January 29, 2002). State Department official Hillary Mann, who has been facilitating secret backchannel discussions with Iranian officials for over a year (see September 11, 2001 and Fall 2001), later confirms that the “Karine A” incident helped prompt Iran’s inclusion in Bush’s speech. The speech prompts the Iranians to skip the monthly meeting with Mann in Geneva. When they resume their meeting in March, the Iranians, according to Mann, are disturbed by Bush’s characterization. “They said they had put their necks out to talk to us and they were taking big risks with their careers and their families and their lives,” she will recall. [Esquire, 10/18/2007]
The State Department’s Bureau of Intelligence and Research (INR) sends Colin Powell a memo warning that the current draft (see January 30-February 4, 2003) of Powell’s UN speech contains 38 “weak” and “unsubstantiated” allegations. It says the allegation that Saddam has plans to conceal his WMDs is from mostly “questionable sources” and that the alleged decontamination vehicles—purported to be evidence of Iraqi WMD—are “water trucks that can have legitimate uses.” The memo emphatically warns that the section on the aluminum tubes is “WEAK” and contains “egregious errors.” It also disputes the speech’s claim that terrorists “could come through Baghdad and pick-up biological weapons.” As a result of the memo’s warnings, 28 of the 38 allegations identified by INR as weak are removed from the draft. Two days later, three more claims are removed when INR objects to seven more of the speech’s allegations. [Isikoff and Corn, 2006, pp. 179]
Australian Ambassador to the United Nations John Dauth tells Trevor Flugge, chairman of Australian Wheat Board (AWB), that the Australian government intends to participate in a US-led effort to overthrow Saddam Hussein. At a subsequent AWB board meeting held on February 27, Flugge tells boardmembers that Dauth “believed US military action to depose Saddam Hussein was inevitable and that at this time the Australian Government would support and participate in such action.” Dauth predicted that Baghdad’s offer to permit the return of UN weapons inspectors would be “likely to stave off US action for 12 to 18 months but that some military action was inevitable.” [Board, 2/27/2002, pp. 10 ; Sydney Morning Herald, 11/22/2006]
President Bush orders the CIA to start focusing on Iraq, and find evidence that Saddam Hussein has weapons of mass destruction. CIA analysts will not find any hard evidence of Iraqi WMDs. [Suskind, 2006, pp. 169]
Flynt Leverett. [Source: Publicity photo]In the wake of the 9/11 attacks, Iran is supportive of US efforts to defeat the Taliban, since the Taliban and Iran have opposed each other. In 2006, Flynt Leverett, the senior director for Middle East affairs on the National Security Council in 2002 and 2003, will recall this cooperation between Iran and the US in a heavily censored New York Times editorial. Gulbuddin Hekmatyar, a notorious Afghan warlord with close ties to bin Laden (see 1984), had been living in Iran since the Taliban came to power in the 1990s. Leverett claims that in December 2001 Iran agrees to prevent Hekmatyar from returning to Afghanistan to help lead resistance to US-allied forces there, as long as the Bush administration does not criticize Iran for harboring terrorists. “But, in his January 2002 State of the Union address, President Bush did just that in labeling Iran part of the ‘axis of evil’ (see January 29, 2002). Unsurprisingly, Mr. Hekmatyar managed to leave Iran in short order after the speech.” [New York Times, 12/22/2006] Hekmatyar apparently returns to Afghanistan around February 2002. He will go on to become one of the main leaders of the armed resistance to the US-supported Afghan government. Iranian cooperation with the US over Afghanistan will continue in a more limited manner, with Iran deporting hundreds of suspected al-Qaeda and Taliban operatives who had fled Afghanistan, while apparently keeping others. The Defense Intelligence Agency issues a four-page Defense Intelligence Terrorism Summary (DITSUM No. 044-02) stating that it is probable that prisoner Ibn al-Shaykh al-Libi intentionally misled debriefers when he claimed Iraq was supporting al-Qaeda in working with illicit weapons. During interviews with al-Libi, the DIA noted the Libyan al-Qaeda operative could not name any Iraqis involved, any chemical or biological material used, or where the alleged training took place. “It is possible he does not know any further details; it is more likely this individual is intentionally misleading the debriefers,” the report says. “Ibn al-Shaykh has been undergoing debriefs for several weeks and may be describing scenarios to the debriefers that he knows will retain their interest.” The DIA report is presumably circulated widely within the government, and is available to the CIA, the White House, the Pentagon, the National Security Council, and other agencies.
No Evidence of Connections between Iraq, al-Qaeda - On the general subject of Iraq’s alleged ties to al-Qaeda, the DIA report notes: “Saddam [Hussein]‘s regime is intensely secular and is wary of Islamic revolutionary movements. Moreover, Baghdad is unlikely to provide assistance to a group it cannot control.” The report also questions the reliability of information provided by high-value al-Qaeda detainees being held in secret CIA facilities or who have been “rendered” to foreign countries where they are believed to undergo harsh interrogation tactics.
Using al-Libi's Information to Bolster Case for War - Information supplied by al-Libi will be the basis for a claim included in an October 2002 speech (see October 7, 2002) by President Bush, in which he states, “[W]e’ve learned that Iraq has trained al-Qaeda members in bomb making and poisons and gases.” Intelligence provided by al-Libi will also be included in Colin Powell’s February speech (see February 5, 2003) to the UN. In that speech, Powell will cite “the story of a senior terrorist operative telling how Iraq provided training in these weapons to al-Qaeda.” [New York Times, 11/6/2005; Washington Post, 11/6/2005; Los Angeles Times, 11/7/2005; Newsweek, 11/10/2005]
Report Released as Proof of Administration's Reliance on Poor Intelligence Sources - Declassified portions of the DIA report will be issued on November 6, 2005 by two senators, Carl Levin (D-MI) and John D. Rockefeller (D-WV). Rockefeller will tell CNN that al-Libi is “an entirely unreliable individual upon whom the White House was placing a substantial intelligence trust.” The situation was, Rockefeller will say, “a classic example of a lack of accountability to the American people.” [Los Angeles Times, 11/7/2005]

One of them is a tall man in robes who officials operating the drone think is Osama bin Laden. However, the victims will turn out to be innocent Afghan villagers, gathering scrap metal. Barbara Hatch Rosenberg. [Source: Public domain]In February 2002, Dr. Barbara Hatch Rosenberg claims in a public speech at Princeton University that she knows the identity of the killer behind the 2001 anthrax attacks (see October 5-November 21, 2001). Rosenberg is a professor of molecular biology at the State University of New York at Purchase, and a biological arms control expert. She states: “There are a number of insiders—government insiders—who know people in the anthrax field who have a common suspect. The FBI has questioned that person more than once… so it looks as though the FBI is taking that person very seriously.” She also claims that the FBI is not that interested in going after this suspect because “[t]his guy knows too much, and knows things the US isn’t very anxious to publicize” (see February 8, 2002). In June 2002, she puts out a paper that details her theory about this suspect. She states that “a number of inside experts (at least five that I know about) gave the FBI the name of one specific person as the most likely suspect.” That same month, she presents her ideas to Senators Tom Daschle and Patrick Leahy, both of whom had been targeted in the anthrax attacks. She also is invited to brief the Senate Judiciary Committee and the Senate Intelligence Committee (see June 24, 2002). Immediately after this, the FBI searches Hatfill’s home while reporters watch, putting him in the public eye as a possible suspect (see June 25, 2002). Rosenberg later denies ever mentioning Hatfill by name. However, one reporter later claims that Rosenberg had specifically given Hatfill’s name as the lead suspect. Furthermore, the description of her suspect exactly matches Hatfill. Hatfill will later blame Rosenberg for the FBI’s interest in him. He will say: “She’s crazy. She caused it.” [Washington City Paper, 7/25/2003] In 2008, Hatfill will be officially cleared of any involvement in the anthrax attacks (see August 8, 2008).
Don Foster. [Source: Al Novak]October 12, 2001, the FBI contracted Don Foster to help with the newly formed anthrax attacks investigation. Foster is a professor of English literature at Vassar College who has been advising the FBI and other government agencies for years due to his expertise in writing analysis. He has sometimes correctly guessed the identities of anonymous authors by analyzing their word usage, not their handwriting styles. By studying news reports of hoax anthrax letters, Foster begins to get interested in Steven Hatfill as a potential suspect. Hatfill had appeared as an expert on biological attacks in some articles dating back to 1998, and he has a curious history while living in Zimbabwe and South Africa in the late 1970s and early 1980s, a time when the racist white government of Zimbabwe (then known as Rhodesia) possibly launched an anthrax attack on their own black citizens. Foster will write in 2003, “When I lined up Hatfill’s known movements with the postmark locations of reported biothreats, those hoax anthrax attacks appeared to trail him like a vapor cloud.” Around February 2002, Foster suggests Hatfill’s name to FBI headquarters as a candidate suspect. But he is told that Hatfill has a good alibi. A month later, he puts forward Hatfill’s name again but is told that people in the Defense Department, State Department, and the CIA have vouched for Hatfill. William Patrick, one of the most respected bioterrorism experts, is Hatfill’s mentor and also vouches for him (see Early March 2002). In April 2002, Foster meets with Barbara Hatch Rosenberg, a professor and biological arms control expert, who has been publicly putting forth theories on who she thinks is behind the anthrax attacks (see February-June 2002). He learns that she has independently come to the same conclusion, that Hatfill should be the prime suspect. Foster will later write that the FBI was “prodded publicly by Rosenberg and privately by myself” to investigate Hatfill more closely. Foster will apparently be eased out of the FBI’s anthrax investigation when he requests some documents to analyze and the FBI does not show them to him. He will write an article in Vanity Fair in 2003 that will strongly imply Hatfill could be behind the anthrax attacks. [Vanity Fair, 9/15/2003]
US Central Command watches as a Predator drone captures images of a very tall man being greeted by a small group of people in the Zawar Kili area of eastern Afghanistan. It is quickly agreed the man could be Osama bin Laden, who is known to be unusually tall. Within minutes, approval is given to launch a Hellfire missile from the drone. By this time, the tall man has broken off from the group with two others. The missile hones in on him and kills him and his two companions. Journalists will later report that the men were villagers who had been scavenging in the woods for scrap metal. [New Yorker, 12/16/2002; Reuters, 5/12/2011] But in trying to determine the identity of the target, US intelligence gets bin Laden family DNA (see Shortly After February 4, 2002).

[Source: CNN]Pakistani police, with the help of the FBI, determine Saeed Sheikh is behind the kidnapping of Daniel Pearl, but are unable to find him. They round up about ten of his relatives and threaten to harm them unless he turns himself in. Saeed Sheikh does turn himself in, but to Ijaz Shah, his former ISI boss. [Boston Globe, 2/7/2002; Vanity Fair, 8/2002] The ISI holds Saeed for a week, but fails to tell Pakistani police or anyone else that they have him. This “missing week” is the cause of much speculation. The ISI never tells Pakistani police any details about this week. [Newsweek, 3/11/2002] Saeed also later refuses to discuss the week or his connection to the ISI, only saying, “I will not discuss this subject. I do not want my family to be killed.” He adds, “I know people in the government and they know me and my work.” [Newsweek, 3/13/2002; Vanity Fair, 8/2002] It is suggested Saeed is held for this week to make sure that Pearl would be killed. Saeed later says that during this week he got a coded message from the kidnappers that Pearl had been murdered. Also, the time might have been spent working out a deal with the ISI over what Saeed would tell police and the public. [Newsweek, 3/11/2002] Several others with both extensive ISI and al-Qaeda ties wanted for the kidnapping are arrested around this time. [Washington Post, 2/23/2002; London Times, 2/25/2002] One of these men, Khalid Khawaja, “has never hidden his links with Osama bin Laden. At one time he used to fly Osama’s personal plane.” [Pakistan News Service (Newark, CA), 2/11/2002]
Though the CIA has chosen not to add anything about the Iraq-Niger allegations (see Between Late 2000 and September 11, 2001, October 15, 2001, October 18, 2001, November 20, 2001, February 5, 2002, March 1, 2002, Late April or Early May 2002-June 2002, and Late June 2002) to the President’s Daily Briefing, it issues a new report on the purported deal, including what it calls “verbatim text” of the agreement between Iraq and Niger (see February 5, 2002). The neoconservatives in the Pentagon (see Early 2002), in author Craig Unger’s words, “pounce… on the new material, and quickly begin working on their own reports that will allege Iraqi attempts to buy enough uranium to make nuclear weapons.” [US Congress, 7/7/2004; Unger, 2007, pp. 239]
The CIA Directorate of Operations issues a second intelligence report from SISMI, Italy’s military intelligence service, on Iraq’s alleged agreement with Niger to purchase 500 tons of uranium annually. This report provides details that were not included in Italy’s October 15 report (see October 15, 2001), including a “verbatim text” of the accord. (It is not clear what the source is for the “verbatim text”. [ERiposte, 3/6/2006] ) According to the report, the purported agreement was signed by Iraqi and Niger officials during meetings held July 5-6, 2000. [US Congress, 7/7/2004; Knight Ridder, 11/4/2005] The SISMI report also draws attention to a 1999 trip to Niger made by Wissam al-Zahawie (see February 1999), Iraq’s former ambassador to the Vatican, and alleges that its mission was to discuss the future purchase of uranium. This is the first report from SISMI that names al-Zahawie and refers directly to his 1999 trip. (SISMI’s previous report had only stated that negotiations had begun by at least 1999.) This report, as well as the previous report, is based on the forged Niger documents. [New Yorker, 10/27/2003; US Congress, 7/7/2004; ERiposte, 11/3/2005] Analysts at the CIA and the DIA are more impressed with the detail and substance of this second report, but analysts at the Department of State’s Bureau of Intelligence and Research (INR) remain skeptical of the report’s allegations noting that it was unlikely that Niger would sell uranium to Iraq because the Nigeriens would have considered the risk of being caught too great. An INR analyst asks the CIA if the source of the report would submit to a polygraph. A CIA analyst who also asks about the source is told by the DO that the source is “very credible.” [US Congress, 7/7/2004]
Shortly after a US Predator drone strike on a target that might be Osama bin Laden (see February 4, 2002), US intelligence gets bin Laden family DNA with help from the Saudi government to help determine the identity of the target. The target turns out to be some innocent Afghan men instead. But now the US has DNA for any future bin Laden identity checks. [Reuters, 5/12/2011]
Vice Admiral Thomas R. Wilson, director of the Defense Intelligence Agency, submits a written testimony, titled Global Threats and Challenges, to the Senate Select Committee on Intelligence. He says that the agency’s “near-term concerns” include another terrorist attack, a major war between India and Pakistan; the worsening of civil unrest within Pakistan; and violence against US interests in Colombia, the Philippines, and Indonesia. Notably, he does not include Iraq as a near-term concern. Rather, in the section devoted to Iraq, he writes: “The on-going UN sanctions and US military presence continue to be the keys to restraining Saddam’s ambitions. Indeed, years of UN sanctions, embargoes, and inspections, combined with US and Coalition military actions, have significantly degraded Iraq’s military capabilities. Saddam’s military forces are much smaller and weaker than those he had in 1991. Manpower and equipment shortages, a problematic logistics system, and fragile military morale remain major shortcomings. Saddam’s paranoia and lack of trust—and related oppression and mistreatment—extend to the military, and are a drain on military effectiveness. Nevertheless, Iraq’s ground forces continue to be one of the most formidable within the region. They can move rapidly and pose a threat to Iraq’s neighbors. Baghdad’s air and air defense forces retain only a marginal defensive capability. The Air Force cannot effectively project air power outside Iraq’s borders. Still, Saddam continues to threaten Coalition forces in the No Fly Zones, and remains committed to interfering with Coalition military operations monitoring his military activities.” [US Congress, 2/6/2001]
The New York Times reports, “[S]enior American intelligence officials have concluded that the meeting between Mr. Atta and the Iraqi officer, Ahmed Khalil Ibrahim Samir al-Ani, did take place. But they say they do not believe that the meeting provides enough evidence to tie Iraq to the Sept. 11 attacks.” A month and a half earlier, the same newspaper had reported that sources in the Czech Republic thought that it had been a different “Mohamed Atta” who had met al-Ani (see December 16, 2001). Unnamed US intelligence officials tell the New York Times that the CIA has no evidence that Saddam Hussein’s government has participated in any militant operations against the United States in nearly a decade. The agency also believes that Saddam Hussein has not provided chemical or biological weapons to al-Qaeda or other militant Islamic organizations. George Tenet tells the Senate Select Committee on Intelligence, “Our major near-term concern is the possibility that Saddam might gain access to fissile material, . . . [and] with substantial foreign assistance, [Iraq] could flight-test a longer-range ballistic missile within the next five years.” [Chicago Tribune, 2/7/2002]
Hassan Ali bin Attash. [Source: US Defense Department]Pakistani forces raid a safe house in Karachi, Pakistan, and arrest 17 suspected al-Qaeda operatives. All 17 will eventually be sent to the US-run Guantanamo prison in Cuba.
Abu Bara al-Taizi - One of them is Abu Bara al-Taizi (a.k.a. Zohair Mohammed Said), who attended the al-Qaeda summit in Malaysia in 2000 (see January 5-8, 2000) and was to be a hijacker for an Asian portion of the 9/11 attacks that never materialized. Al-Taizi will be handed to the US on February 27, and then transferred to Guantanamo a few months later.
Abdu Ali Sharqawi - The safe house is run by Abdul Rahim al-Sharqawi, a Yemeni commonly known as Riyadh the Facilitator. He is arrested as well, but he will not be handed to the US and then sent to Guantanamo until September 2004. [US Department of Defense, 7/7/2008; US Department of Defense, 10/25/2008] Another Guantanamo prisoner, Hassan Ali bin Attash, will later say that he and al-Sharqawi were held in a Jordanian prison for over a year. That would explain most of the time between al-Sharqawi’s arrest and his transfer to Guantanamo. [US Department of Defense, 6/25/2008] The New York Times will later identify al-Sharqawi as one of the four most important al-Qaeda leaders captured in the first year after 9/11. Al-Sharqawi's Al-Qaeda Activity - According to al-Sharqawi’s Guantanamo file, he joined al-Qaeda after fighting in Bosnia in 1995 and was closely linked to many al-Qaeda leaders. For a time, he even took part in weekly planning meetings with Osama bin Laden and others. In the summer of 2001, he began running the safe house in Karachi. His file says that he photo-identifies 11 of the 9/11 hijackers and provides varying amounts of information on each of them. He estimates that he helped over 100 al-Qaeda operatives leave Pakistan in the post-9/11 crackdown before his safe house was shut down. 9/11 mastermind Khalid Shaikh Mohammed and hijacker associate Ramzi bin al-Shibh passed through his safe house in January 2002, a few weeks before the safe house is raided. As of late 2008, al-Sharqawi, al-Taizi, and nine others captured in the raid remain imprisoned in Guantanamo, while six others have been transferred out. [US Department of Defense, 7/7/2008; US Department of Defense, 10/25/2008] Most of the above is based on Guantanamo files leaked to the public in 2011 by the non-profit whistleblower group WikiLeaks. There are many doubts about the reliability of the information in the files (see April 24, 2011).
Neighbor's Tip Led to Raid - The safe house was discovered because the Pakistani Army asked the public for leads on the movements of suspicious foreigners. Apparently one or more neighbors pointed out the safe house (see Late 2001).
Attorney General John Ashcroft says “I want to encourage…all Americans everywhere to be on the highest state of alert.” The FBI warns of a threat from Yemeni or Saudi Arabian terrorists who may be planning an imminent attack. [CNN, 2/12/2002] It is later revealed that the threat hadn’t been corroborated by other US intelligence agencies. In addition, the threat actually indicated a more likely attack in Yemen. This announcement was made the same day that Enron CEO Kenneth Lay appeared before Congress. A week earlier, the White House had been ordered to refrain from destroying any documentation related to Enron. [Rolling Stone, 9/21/2006 ]
Senior Bush administration officials say President Bush has decided to oust Iraqi despot Saddam Hussein from power. “This is not an argument about whether to get rid of Saddam Hussein,” one official says. “That debate is over. This is… how you do it.”
CIA, Pentagon Making Plans for Regime Change - Bush has ordered the CIA, the Pentagon, and other agencies to come up with a plan combining military, diplomatic, and covert actions to force Hussein from power. A military strike is not yet imminent, but Bush has decided that Hussein and his putative weapons of mass destruction are such a threat to US security that he must be removed from power, even if US allies do not help. The CIA has already presented Bush with a plan to destabilize Hussein’s regime, incorporating covert action campaigns, sabotage, information warfare, and stepped-up bombing runs throughout the northern and southern “no-fly” zones. Bush is reportedly enthusiastic about the plan, and the CIA has begun assigning officers to the task. Reporters Warren P. Strobel and John Walcott write: “The president’s decision has launched the United States on a course that will have major ramifications for the US military, the Middle East’s future political alignment, international oil flows, and Bush’s own war on terrorism.”
Some Allies Dubious - Allies such as Russia have already expressed grave doubts about the wisdom of such a series of actions, and military experts warn that any campaign in Iraq would be long, bloody, and difficult to bring to a satisfactory conclusion. Nevertheless, one foreign leader who recently met with Bush came away “with the feeling that a decision has been made to strike Iraq, and the ‘how’ and ‘when’ are still fluid,” according to a diplomat.
Cheney to Inform Middle Eastern Leaders of US Intentions - Vice President Cheney will soon depart for a visit to 11 Middle East nations; while the public explanation is that he wants to listen to those nations’ views on the US’s Iraq policy, in reality, Cheney will inform them that the US will overthrow the Hussein regime. One senior official says: “He’s not going to beg for support. He’s going to inform them that the president’s decision has been made and will be carried out, and if they want some input into how and when it’s carried out, now’s the time for them to speak up.” At least one Middle Eastern ally, Egypt, has reservations about such a plan. Egyptian Ambassador Nabil Fahmy said last week that Bush should keep the US focus on fighting international terrorism, where he has broad international backing. “If you mix two issues together, you will lose this focus,” he said.
Debate over Role of Chalabi, INC - There is still sharp debate within the administration over the role that Ahmed Chalabi’s Iraqi National Congress will play in the overthrow and subsequent realignment. Many neoconservatives, particularly in the offices of Vice President Cheney and Defense Secretary Donald Rumsfeld, tout Chalabi as the next leader of Iraq, but others are not sanguine about Chalabi and his organization, with CIA officials warning that the INC is riven by internal debate and undoubtedly riddled with spies from Iraq and Iran. The Defense Intelligence Agency (DIA) issues “a finished intelligence product” summarizing the February 5, 2002 SISMI report (see February 5, 2002). The report, entitled “Niamey Signed an Agreement to Sell 500 Tons of Uranium a Year to Baghdad,” states as irrefutable fact that Iraq intends to buy weapons-grade uranium from Niger (see Between Late 2000 and September 11, 2001, October 15, 2001, October 18, 2001, November 20, 2001, February 5, 2002, March 1, 2002, Late April or Early May 2002-June 2002, and Late June 2002). It concludes, “Iraq probably is searching abroad for natural uranium to assist in its nuclear weapons program.” It does not comment on the credibility of the sourcing. The report is sent directly to Vice President Dick Cheney. Within hours, Cheney directs the CIA (see February 5, 2002) to investigate the claims. According to the Senate Intelligence Committee’s 2004 report on Iraqi WMD (see July 9, 2004), CIA and DIA analysts find the subsequent reports more informative and believable than the first, more sketchy reports (see February 5, 2002). The CIA’s Directorate of Operations tells one agency analyst that the report comes from a “very credible source.” Analysts with the State Department’s Bureau of Intelligence and Research (INR) continue to find the reports unconvincing. [US Congress, 7/7/2004; Unger, 2007, pp. 239] Former CIA analyst Ray McGovern will later describe Cheney’s receipt of this document as “odd.” “[I]n more than two years of briefing then-Vice President George H. W. Bush every other morning, not once did he ask a question about a DIA report or even indicate that he had read one,” McGovern will note. “That this particular report was given to Cheney almost certainly reflects the widespread practice of ‘cherry picking’ intelligence.” [AfterDowningStreet (.org), 7/25/2005]

[Source: Norman Transcript]A former high-ranking CIA officer named David Edger says that the CIA had tracked “some of the people responsible for the Sept. 11 attacks on the World Trade Center” in Germany, but failed to stop them. Between 1997 and 2001, Edger was CIA station chief in Berlin, Germany, and thus directed CIA surveillance and infiltration attempts against the Hamburg cell of 9/11 hijackers, and other cells in Germany (see May 1997). In August 2001, Edger retired and moved to Oklahoma to teach (see August 2001), and on this day he makes some intriguing comments to the Norman Transcript, a newspaper in Norman, Oklahoma. According to the Norman Transcript: “Up until his appointment with [the University of Oklahoma] six months ago, Edger’s work with the CIA focused on terrorist groups in Germany. One of the three cells he was tracking included some of the people responsible for the Sept. 11 attacks on the World Trade Center. He said although officers knew members of the cell and some of what they were doing, they had no idea that they would meet in London and go to different parts of the US, where they would learn to fly planes to crash into the World Trade Center. ‘In that case, we failed,’ Edger said.” [Norman Transcript (Oklahoma), 2/12/2002]
What Did the CIA Know? - While it is clear that the CIA was monitoring some members of the al-Qaeda Hamburg cell containing a few of the 9/11 hijackers (see December 1999 and Spring 2000), it is unclear just what it might have known of the hijackers in Hamburg before 9/11 (see January 31, 1999, March 1999, 2000, and September 2000-July 24, 2001). According to some reports, the CIA monitored 9/11 hijacker Mohamed Atta for six months in early 2000 (see January-May 2000).
Edger's Knowledge Remains a Mystery - Although Edger would seem to be in a prime position to know just what the CIA might have known about the hijackers and their Hamburg associates before 9/11, there are no signs he is interviewed by the 9/11 Congressional Inquiry or 9/11 Commission. He also will not make any similar comments to any newspaper except for the obscure Norman Transcript.

[Source: CNN]Samir al-Hada, an al-Qaeda operative who helped run a vital al-Qaeda communications hub in Sana’a, Yemen (see Late 1998-Early 2002), dies while being pursued by Yemeni police. The Yemeni police were tipped off by Samir’s landlord that he was planning to flee the country when he failed to produce identity documents to renew his lease. The police stake out his hideout for a week but he escapes and, during the chase, a grenade explodes in his hand and kills him. He was the brother-in-law of 9/11 hijacker Khalid Almihdhar. [BBC, 2/13/2002; Guardian, 2/14/2002; CNN, 2/14/2002; Al Ahram, 2/21/2002] After the attack, the police search the house where al-Hada had been staying and seize weapons, documents, books, a mobile phone, and a piece of paper containing phone numbers. [CBS News, 2/13/2002; BBC, 2/15/2002] The al-Hada hub was used in planning the embassy bombings in 1998 (see August 4-25, 1998 and October 4, 2001), the attack on the USS Cole in 2000 (see October 14-Late November, 2000), and 9/11 (see Early 2000-Summer 2001). It had been monitored by the NSA since the late 1990s (see Late August 1998 and Early 1999). Ahmed al-Hada is in Yemeni custody by 2006; it has not been stated when or how he was captured. [Wright, 2006, pp. 378] It appears that the communications hub is no longer functional after al-Hada’s death, as there are no more references to it operating, several of the al-Hada clan are rounded up, the hub is again discussed by the media (see February 2001 and After), and the clan’s patriarch, Ahmed al-Hada, is again named in the media. Alan Foley, the head of the Director of Central Intelligence’s (DCI) Center for Weapons Intelligence, Nonproliferation, and Arms Control (WINPAC) completes a “senior publish when ready” report, an intelligence assessment with limited distribution, which states, “[I]nformation on the alleged uranium contract between Iraq and Niger comes exclusively from a foreign government service report (see October 15, 2001) that lacks crucial details, and we are working to clarify the information and to determine whether it can be corroborated.” The report discusses the details of a recent foreign intelligence report (see February 5, 2002) issued by the CIA Directorate of Operations and says that “some of the information in the report contradicts reporting (see November 20, 2001) from the US Embassy in Niamey, Niger. US diplomats say the French government-led consortium that operates Niger’s two uranium mines maintains complete control over uranium mining and yellowcake production.” The CIA sends a separate version of this assessment to Vice President Dick Cheney. Unlike the official version, the copy sent to Cheney names the foreign intelligence agency, which the New Yorker will later reveal is the Italian SISMI. Vice President Dick Cheney asks his morning intelligence briefer, CIA briefer David Terry, about the Defense Intelligence Agency’s recent analysis (see February 12, 2002) of SISMI’s February 5 report (see February 5, 2002) suggesting that Iraq attempted to purchase uranium from Niger. [Time, 7/21/2003; New Yorker, 10/27/2003; US Congress, 7/7/2004] Cheney is reportedly dissatisfied with his briefer’s initial response, and asks the agency to take another look (see Shortly after February 12, 2002). [CIA Task Sheet, 2/13/2002; New Yorker, 10/27/2003] Cheney’s questions quickly reach the desk of senior CIA case officer Valerie Plame Wilson, who accepts the suggestion of another CIA officer to send her husband, Joseph Wilson, to Niger to investigate the claims (see February 13, 2002). The CIA’s DO Counterproliferation Division (CPD) sends a cable to an unnamed government office or official (the identity of which is redacted in the source document) requesting approval to send former ambassador Joseph Wilson to Niger to investigate Italian intelligence reports that Iraq has attempted to purchase uranium from that country (see February 13, 2002). The cable also requests additional information from Italy regarding the matter. [US Congress, 7/7/2004]

[Source: PEP]In response to questions from Vice President Dick Cheney (see (February 13, 2002)), CIA operative Valerie Plame Wilson and officials from the CIA’s DO counterproliferation division (CPD) meet to discuss what the agency should do to determine the validity of recent Italian intelligence reports (see October 15, 2001 and February 5, 2002) alleging that Iraq had sought to purchase uranium from Niger. During the meeting, Plame Wilson suggests sending her husband, Joseph Wilson, an Africa expert and former US diplomat, to Niger to investigate the reports. [US Congress, 7/7/2004] The meeting is chronicled in an internal agency memo obtained by the Wall Street Journal in October 2003. [Wall Street Journal, 10/17/2003] Intelligence officials subsequently will not deny that Plame Wilson was involved in the decision to send Wilson to Niger, but will say she was not “responsible” for the decision. [Wall Street Journal, 10/17/2003]
CIA Alerted to Cheney's Concerns - In her 2007 book Fair Game, Plame Wilson recalls that shortly after Cheney’s initial questions, a young officer rushes into her CPD office and tells her “someone from the vice president’s office” just called the officer on her secure telephone line. The caller, apparently a member of Cheney’s staff, wants information about an intelligence report that the Italian government has passed to the US, alleging that in 1999 Iraq attempted to buy yellowcake uranium from Niger. Cheney is, according to the staffer, “interested and want[s] more information.” Plame Wilson will write, “If the report was true at all, I knew that it would be damning evidence indeed that Iraq was seeking to restart its nuclear program.”
'Nonplussed' at White House Contact - “I was momentarily nonplussed that someone from the vice president’s office had reached down into the junior working levels of the agency to discuss or find an answer to an intelligence report,” she will write. “In my experience, I had never known that to happen. There were strict protocols and procedures for funneling intelligence to policy makers or fielding their questions. Whole offices within the agency were set up and devoted to doing just that. A call to a random desk officer might get the policy maker a quick answer in the heat of the moment, but it was also a recipe for trouble. Handing a senior policy maker ‘raw’ intelligence that had not been properly vetted, placed into context, or appropriately caveated by intelligence professionals usually led to misinterpretation—at a minimum.” She adds that at the time, she is “not aware of the unprecedented number of visits the vice president had made to our headquarters to meet with analysts and look for any available evidence to support the Iraq WMD claims the administration was beginning to make.… I was still blissfully ignorant of any special visits or pressure from the administration vis-a-vis Iraq. I just wanted to get some answers.”
Decision to Ask Wilson Originates with Records Officer, Not Plame Wilson - Plame Wilson tables her concerns about the unusual contact, and begins pondering how best to find answers to Cheney’s questions. The “first and most obvious choice,” she will write, “would be to contact our [REDACTED] office in Niger and ask them to investigate these allegations using local sources available on the ground.” But the budget cuts of the mid-1990s had forced the closing of numerous CIA offices in Africa, including its station in Niamey, Niger. Plame Wilson will recall, “A midlevel reports officer who had joined the discussion in the hallway enthusiastically suggested, ‘What about talking to Joe about it?’” The reports officer is referring to Plame Wilson’s husband, former ambassador Joseph Wilson. “He knew of Joe’s history and role in the first Gulf War (see September 5, 1988 and After and September 20, 1990), his extensive experience in Africa, and also that in 1999 the CIA had sent Joe on a sensitive mission to Africa on uranium issues. Of course, none of us imagined the firestorm this sincere suggestion would ignite. At the moment, the only thought that flashed through my mind was that if Joe were out of the country for an extended period of time I would be left to wrestle two squirmy toddlers into bed each evening.… So I was far from keen on the idea, but we needed to respond to the vice president’s office with something other than a lame and obviously unacceptable, ‘We don’t know, sorry.’” Plame Wilson and the reports officer make the suggestion to send Wilson to Niger; her supervisor decides to meet with Wilson “and the appropriate agency and State [Department] officials.” At her supervisor’s behest, Plame Wilson sends an e-mail to her division chief (whom she will only identify as “Scott”), informing him of the decision and noting that “my husband has good relations with both the PM [prime minister] and the former minister of mines (not to mention lots of French contacts), both of whom could possibly shed some light on this sort of activity.” Plame Wilson will write that her words are intended to “gently remind [her division chief] of Joe’s credentials to support why my boss thought he should come into headquarters in the first place.” She will note: “Months later, those words would be ripped out of that e-mail and cited as proof that I had recommended Joe for the trip (see February 13, 2002). But at the time, I simply hit the ‘send’ button and moved on to the other tasks that were demanding my attention.” That night, Plame Wilson broaches the subject of going to Niger with her husband; he agrees to meet with her superiors at the CPD. Cheney Later Denies Knowledge of Iraq-Niger Claims - During the investigation of the Plame Wilson leak (see September 26, 2003), Cheney will repeatedly deny any knowledge that the CIA was following up on his request for more information. This is a lie. Among other refutations, the Senate Intelligence Committee will report in 2004 that he was told on February 14 that CIA officers were working with clandestine sources to find out the truth behind the Niger allegations (see July 9, 2004). Wilson’s wife, Valerie Plame Wilson, a senior CPD officer (see April 2001 and After), relays the request to him explaining that “there’s this crazy report” asserting that Iraq made a deal with Niger on the sale of a large quantity of uranium. [US Congress, 7/7/2004] Shortly afterwards, she sends an overseas cable requesting concurrence with the agency’s decision to send her husband to Niger (see February 13, 2002). She writes, “[B]oth State and [the Department of Defense] have requested additional clarification and indeed, the vice president’s office just asked for background information” (see (February 13, 2002)). The CIA publishes a classified report that concludes, in part, “information on the alleged uranium contract between Iraq and Niger comes exclusively from a foreign government service report that lacks crucial details, and we are working to clarify the information and to determine whether it can be corroborated.” [Central Intelligence Agency, 4/3/2003 ; Central Intelligence Agency, 5/30/2003 ]
The US embassy in Niger disseminates a cable reporting that the alleged Iraq-Niger uranium deal “provides sufficient detail to warrant another hard look at Niger’s uranium sales. The names of GON [government of Niger] officials cited in the report track closely with those we know to be in those, or closely-related positions. However, the purported 4,000-ton annual production listed is fully 1,000 tons more than the mining companies claim to have produced in 2001.” The report says that US ambassador to Niger Barbro Owens-Kirkpatrick met with the Nigerien foreign minister to ask for an unequivocal assurance that Niger is not selling uranium to so-called “rogue states.” The cable also notes that in September 2001 Nigerien Prime Minister Mamadou Tandja had informed the US embassy that there were buyers like Iraq who had expressed willingness to pay more for Niger’s uranium than France, but he assured them at that time that “of course Niger cannot sell to them.” However, the cable concludes that “we should not dismiss out of hand the possibility that some scheme could be, or has been, underway to supply Iraq with yellowcake from here.” [US Congress, 7/7/2004] Shortly after the cable is sent, Owens-Kirkpatrick reports to the State Department that “there was no possibility” that Iraq made any sort of uranium deal with Niger. She comes to this conclusion after reviewing the possibility of such a deal with the director general of Niger’s French-led uranium consortium. [US Congress, 7/7/2004; Unger, 2007, pp. 229]
The CIA’s Directorate of Operations (DO) Counterproliferation Division (CPD) holds a meeting with former ambassador Joseph Wilson, intelligence analysts from both the CIA and State Department’s Bureau of Intelligence and Research (INR), and several individuals from the DO’s Africa and CPD divisions. The purpose of the meeting is to discuss the merits of sending Wilson to Niger. Wilson is introduced by his wife Valerie Plame Wilson, who heads CPD’s Joint Task Force on Iraq (JTFI). [US Congress, 7/7/2004, pp. 59; Isikoff and Corn, 2006, pp. 94-95]
Wife Does Not Participate in Meeting - In her 2007 book Fair Game, Plame Wilson will write that she brings her husband into the briefing room, introduces him to the “10 or so participants,” and “[a]fter a minute or so, I went back to my desk to attend to what seemed like a hundred other operational crises. When the meeting broke, Joe poked his head in my office to say that the group had asked him to consider going to Niger to discuss the report.” [Wilson, 2007, pp. 111]
Wilson's Qualifications - Wilson will later describe himself as “the insider increasing [the CIA analysts’] store of information, supplying that perspective missing from their raw data. I had served as a junior diplomatic officer in Niger in the mid-1970s, a period that happened to coincide with the growth in the uranium business there. We had followed this issue closely from the American Embassy in Niamey, Niger’s capital, just as my staff and I had when I was ambassador to Gabon, another uranium-producing country, from 1992 to 1995. When I worked on the National Security Council in the Clinton administration two years later, among my areas of responsibility was the African uranium industry. Rarely did conversations with Africans from uranium-producing countries fail to touch on the subject. Niger, where I had traveled frequently over the years, was always of particular interest.” [Wilson, 2004, pp. 8]
Details Shared with Wilson - In the meeting, Wilson learns of a report that purports to document a memorandum of sale from Niger to Iraq, and that the report had aroused the interest of Vice President Dick Cheney (see (February 13, 2002)). Cheney’s office has tasked the CIA to determine the truth or falsity of the report. The report is lacking in key details. Wilson’s knowledge of the region, particularly of the government and private interests involved in mining and distributing uranium, will be particularly helpful. Wilson later writes, “The Nigeriens were the same people I had dealt with during and after my time at the National Security Council, people I knew well.” The former minister of mines, the man responsible for oversight of the industry at the time of the alleged sales, is a friend of his.
Skepticism among Participants about Report - Wilson will later describe himself as “skeptical, as prudent consumers of intelligence always are about raw information.” He will note that much of this kind of intelligence is classified as “rumint,” or rumors passing as fact, and is usually “no more reliable than Bigfoot sightings. Rumint is a necessary and unfortunate reality in a world where many people will tell you what they think you want to hear, as opposed to simple facts.” [Wilson, 2004, pp. 14-15] Notes taken by INR analyst Douglas Rohn, as well as e-mails from other participants, indicate that INR expresses skepticism that the alleged uranium contract could have taken place. Rohn, who served as deputy chief of mission in Niger during the ‘90s, writes that it would have been very difficult to conceal such a large shipment of yellowcake because “the French appear to have control of the uranium mining, milling and transport process, and would seem to have little interest in selling uranium to the Iraqis.” INR also says that the embassy in Niger has good contacts and is thus in a position to get to the truth on the matter, and therefore believes the proposed trip to Niger would be redundant. Others attending the meeting argue that the trip would probably not resolve the matter because the Nigeriens would be unlikely to admit to a uranium sales agreement with Iraq. An e-mail from a WINPAC analyst to CPD following the meeting notes, “[I]t appears that the results from this source will be suspect at best, and not believable under most scenarios.” CPD nonetheless concludes that sending Wilson would be worth a try. [US Congress, 7/7/2004, pp. 59; Isikoff and Corn, 2006, pp. 94-95]
Open and Public Visit - Wilson is willing, but points out that he is not a spy, but a former diplomat with no experience with clandestine work. He will be recognized in Niger. Therefore, there can be no expectation of any covert or clandestine actions on his part; everything he does will be open and above board. He also insists on obtaining the approval of both the State Department and the US Ambassador to Niger, Barbro Owens-Kirkpatrick, before entering the country. He expects no payment for his visit, but will accept reimbursement for expenses. The others in the meeting agree. The rest of the two-hour meeting is spent considering and plotting out various scenarios, based on who he might see and what he might learn during his visit. [Wilson, 2004, pp. 16-17] “I went through what I knew about… uranium,” Wilson later recalls. “I went through what I knew about the personalities.… People chimed in, and I answered them as best I could. It was a kind of free-for-all, and at the end they sort of asked, ‘Well, would you be able to clear your schedule and go out there if we wanted?’ and I said, ‘Sure.’” [Vanity Fair, 1/2004]

Wilson, a retired US diplomat, to Niger to investigate claims that Iraq had sought to purchase uranium from that country (see February 13, 2002). The CIA pays Wilson’s expenses for the trip, but does not pay him in any other respect. The identity of the party who requests the mission is later disputed. While Wilson will claim the trip was requested directly by Dick Cheney’s office, other sources will indicate that the CIA had decided (see February 19, 2002) that a delegation to Niger was needed in order to investigate questions raised by one of Dick Cheney’s aides (see (February 13, 2002)). Reason behind Request - Former CIA analyst Melvin Goodman will later note that “Wilson was asked to go to Niger for one specific purpose. It was the CIA’s idea to get Cheney off their backs. Cheney would not get off their backs about the yellowcake documents. They couldn’t get Cheney to stop pressing the issue. He insisted that was the proof of reconstitution of [Iraq’s nuclear] program.” [Dubose and Bernstein, 2006, pp. 214]
Normal Skepticism - Wilson goes into the situation with a healthy dose of skepticism. “My skepticism was the same as it would have been with any unverified intelligence report, because there is a lot of stuff that comes over the transom every day,” he will recall in 2006. Wilson knows nothing of the influence of the Pentagon neoconservatives (see July 8, 1996, January 26, 1998, July 1998, September 2000, Late December 2000 and Early January 2001, Shortly after January 20, 2001, and Shortly After September 11, 2001) or the growing rift in the intelligence community over the reports: “I was aware that the neocons had a growing role in government and that they were interested in Iraq,” he will recall. “But the administration had not articulated a policy at this stage.” He is not given a copy of the Niger documents before leaving for Africa, nor is he told of their history. “To the best of my knowledge, the documents were not in the possession of the [CIA] at the time I was briefed,” he will recall. “The discussion was whether or not this report could be accurate. During this discussion, everyone who knew something shared stuff about how the uranium business worked, and I laid out what I knew about the government in Niger, what information they could provide.” With this rather sketchy preparation, Wilson leaves for Niger. [Unger, 2007, pp. 240; Wilson, 2007, pp. 113] Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will later write, “He figured that if the vice president had asked a serious and legitimate question, it deserved a serious answer and he would try to help find it.” [Wilson, 2007, pp. 111]
No Trouble Finding Information - Wilson, who knows the Nigerien government and many of its officials, has little trouble finding the information he needs in the following week. In 2006, he will recall: “Niger has a simplistic government structure. Both the minister of mines and the prime minister had gone through the mines. The French were managing partners of the international consortium [which handles Niger’s uranium]. The French mining company actually had its hands on the project. Nobody else in the consortium had operators on the ground.” Wilson also personally knows Wissam al-Zahawie, Iraq’s ambassador to the Vatican who supposedly negotiated the uranium deal with Niger (see February 1999). Wilson will later observe: “Wissam al-Zahawie was a world-class opera singer, and he went to the Vatican as his last post so he could be near the great European opera houses in Rome. He was not in the Ba’athist inner circle. He was not in Saddam [Hussein]‘s tribe. The idea that he would be entrusted with the super-secret mission to buy 500 tons of uranium from Niger is out of the question.” [Unger, 2007, pp. 240-241] Wilson meets with, among other officials, Niger’s former minister of mines, Mai Manga. As later reported by the Senate Intelligence Committee (see July 9, 2004), Manga tells Wilson “there were no sales outside of International Atomic Energy Agency (IAEA) channels since the mid-1980s,” and he “knew of no contracts signed between Niger and any rogue states for the sale of uranium.” Manga says a “French mining consortium controls Nigerien uranium mining and keeps the uranium very tightly controlled from the time it is mined until the time it is loaded onto ships in Benin for transport overseas,” and, “it would be difficult, if not impossible, to arrange a special shipment of uranium to a pariah state given these controls.” [CounterPunch, 11/9/2005]
Meeting with US Ambassador - Wilson arrives in Niger on February 26, two days after Marine General Carlton W. Fulford Jr.‘s meeting (see February 24, 2002) with Nigerien officials. Wilson first meets with US Ambassador to Niger Barbro Owens-Kirkpatrick, a veteran Foreign Service official, whom Wilson will later describe as “crisp” and well-informed. Over tea in the US Embassy offices in Niamey, Niger’s capital, Owens-Kirkpatrick tells Wilson that she has already concluded that the allegations of uranium sales to Iraq are unfounded. “She had already debunked them in her reports to Washington,” Wilson will later recall. “She said, yeah, she knew a lot about this particular report. She thought she had debunked it—and, oh, by the way, a four-star Marine Corps general had been down there as well—Carlton Fulford. And he had left satisfied there was nothing to report.” [Wilson, 2004, pp. 20-22]
Details of Alleged Uranium Production - Niger extracts uranium from two mines, both located in remote locations in the Sahara Desert. It takes well over a day to drive from the mines to Niamey. The mines are owned by a consortium of foreign companies and the Nigerien government, and managed by a French mining company, COGEMA. Because of a recent upswing in the production of Canadian uranium, Niger’s uranium is mined at a net loss, and its only customers are consortium members. Wilson will later write, “[T]he Nigerien government has sold no uranium outside the consortium for two decades.” If Iraq had bought 500 tons of uranium, as the story is told, that would have represented a 40 percent production increase. “There is no doubt,” Wilson will later write, “that such a significant shift from historic production schedules would have been absolutely impossible to hide from the other partners, and most certainly from the managing partner, COGEMA. Everyone involved would have known about it.” Any Nigerien government decision to produce such an amount of uranium would have involved numerous government officials and many well-documented meetings. Because the transaction would have been to a foreign country, Niger’s Foreign Ministry would also have been involved in the decision. To sell Iraq uranium during that time would have been a violation of international law and of UN sanctions against Iraq, a weighty decision that would have ultimately been made by the president of Niger in conjuction with the foreign minister and the minister of mines. Such a decision would have been published in the Nigerien equivalent of the Federal Register and would have dramatic tax and revenue implications. The unexpected huge infusion of cash from the sale would have had a strong impact on the Nigerien economy, and would have been much anticipated and talked about throughout the Nigerien business community. [Wilson, 2004, pp. 22-25]
Off-the-Books Production Virtually Impossible - It is conceivable that such an enormous operation could have been conducted entirely “off the books,” Wilson will write, but virtually impossible to pull off. True, a military junta was in power at the time of the alleged sale, one that felt no responsibility or accountability to the Nigerien people. But even a secret transaction would have been impossible to conceal. Such a transaction would have involved thousands of barrels of clandestinely shipped uranium, extensive and complex adjustments to shipping schedules, and other ramifications. “It simply could not have happened without a great many people knowing about it, and secrets widely known do not remain hidden for long. And again, COGEMA, as the managing partner, would have had to know and be complicit.” Add to that Niger’s dependence on US foreign economic aid and its unwillingness to threaten the loss of that aid by secretly shipping uranium to a country that the US considers a dangerous rogue nation. All told, Wilson concludes, the possibility of such a clandestine operation is remote in the extreme. [Wilson, 2004; Wilson, 2004]
1999 Meeting with Iraqi Official - While speaking with a US Embassy official, Wilson learns about a 1999 meeting between the embassy official and an Iraqi representative in Algiers, perhaps in concert with a similar meeting between Iraqi officials and Niger’s prime minister (see June 1999). [Wilson, 2004, pp. 27-28]
Confirmation that Allegations are Unrealistic - After spending several days talking with current government officials, former government officials, and people associated with the country’s uranium business, Wilson concludes the rumors are completely false. He will later call the allegations “bogus and unrealistic.” [Washington Post, 6/12/2003 ; Knight Ridder, 6/13/2003; Independent, 6/29/2003; New York Times, 7/6/2003; CBS News, 7/11/2003; Vanity Fair, 1/2004; Wilson, 2004, pp. 20-28, 424; Vanity Fair, 5/2004, pp. 282; Wilson, 2007, pp. 113]

In the wake of the kidnapping of Daniel Pearl and suspected ISI ties to the kidnapping plot, Pakistani President Pervez Musharraf is said to begin a “quiet and massive overhaul” of the ISI. However, one senior military source who once served in the ISI warns, “The biggest problem we have here are the rogue elements in the intelligence agencies, especially those who at some time became involved with the CIA.” The ISI is so used to operating independently that even honest agents may be difficult to control. Many may willfully disobey orders. “Among the more dangerous, sources say, are those who acted as Pakistan’s official liaison between the Pakistan Army and militant groups, such as the Kashmiri-oriented Harkat ul-Mujahedeen and Lashkar-e-Toiba, both of which are on the United States’ list of terrorist organizations. The ISI was also a crucial link between Pakistan and the Taliban in Afghanistan.” [Christian Science Monitor, 2/22/2002] By early 2003, the Financial Times will note that Musharraf’s attempts at reforms have largely been abandoned. An expert on the region comments, “It is no longer a question of whether Pakistan is going backwards or forwards. It’s a question of how rapidly it’s going backwards.” [Financial Times, 2/8/2003]
Anthrax under magnification. [Source: T. W. Geisbert / USAMRIID]Scientist Bruce Ivins submits a sample of the anthrax he has been using to FBI investigators. Ivins works at USAMRIID, the US Army’s top bioweapons laboratory, and is helping with the anthrax investigation even though the FBI has reason to believe the anthrax could have come from USAMRIID (see Mid-October 2001 and Winter 2001). Ivins is using a variety of the Ames anthrax strain known as RMR-1029. A subpoena dated February 22, 2002 is issued to Ivins and other scientists, telling them to submit samples of their anthrax. Ivins submits his sample on February 27, apparently before he receives the subpoena. He is the only scientist to submit a sample before getting the subpoena. He had been discussing with investigators what kind of protocol to use for the samples, so he is familiar with the desire for the samples and how to submit them, but he does not completely the protocol with his sample. The FBI will soon destroy the sample he submits because it has not been prepared using the protocol, which is necessary for it to be used as valid evidence in trial. In April 2002, Ivins will submit a second anthrax sample. Around 2004, scientists will discover some unique genetic markers to the anthrax used in the 2001 attacks and will start comparing that anthrax to other anthrax. No match will be found between Ivins’s April 2002 sample and the anthrax used in the attacks. However, Paul Keim, a biologist at Northern Arizona University and an expert at distinguishing various strains of anthrax, keeps duplicates of all the anthrax samples sent to the FBI. In early 2007, it will be discovered that he still has a copy of Ivins’s February 2002 sample. A match will be discovered between that RMR-1029 sample and the sample from the attacks (see Early 2007). However, at least 100 scientists had access to this sample (see Late 2005-2006). Carlton W. Fulford Jr. [Source: US Marine Corps]Marine General Carlton W. Fulford Jr., deputy commander of the US European Command, arrives in Niger on a scheduled refueling stop. At the request of US Ambassador to Niger Barbro Owens-Kirkpatrick, Fulford joins the ambassador at a meeting with Niger’s President Mamadou Tandja and Foreign Minister Aichatou Mindaoudou. He explains the importance of keeping Niger’s ore deposits secure. At the meeting, President Tandja assures the ambassador and General Fulford that Niger is determined to keep its uranium “in safe hands.” [Washington Post, 7/15/2003; Voice of America, 7/15/2003; Vanity Fair, 5/2004, pp. 282; US Congress, 7/7/2004] After the meeting, Fulford concludes that Niger’s uranium is securely under the control of a French consortium and that there is little risk that the material will end up in the wrong hands. These findings are passed on to General Joseph Ralston who provides them to General Richard B. Myers, chairman of the Joint Chiefs of Staff. [Washington Post, 7/15/2003; Voice of America, 7/15/2003; Vanity Fair, 5/2004, pp. 282] The Pentagon will later say that Defense Secretary Donald Rumsfeld was not informed about the trip or its conclusions. Mullah Mohammed Khaksar. [Source: Agence France-Presse]Time magazine reports the CIA is still not interested in talking to Mullah Mohammed Khaksar, easily the highest ranking Taliban defector. Khaksar was the Taliban’s deputy interior minister, which put him in charge of vital security matters. He was secretly giving the Northern Alliance intelligence on the Taliban since 1997, and he had sporadic and mostly unsuccessful efforts trying to give information to the US while he still worked for the Taliban (see April 1999 and Between September 12 and Late November 2001). In late November 2001, he defected to the Northern Alliance and was given an amnesty due to his secret collaboration with them. He continues to live in his house in Kabul after the defeat of the Taliban, but is unable to get in contact with US intelligence. In February 2002, Time magazine informs US officials that Khaksar wants to talk, but two weeks later the magazine will report that he still has not been properly interviewed. [Time, 2/25/2002] The US may be reluctant to speak to him because much of what he has to say seems to be about al-Qaeda’s links with the Pakistani ISI, and the US is now closely working with Pakistan. Time magazine reports, “The little that Khaksar has divulged to an American general and his intelligence aide—is tantalizing.… He says that the ISI agents are still mixed up with the Taliban and al-Qaeda,” and that the three groups have formed a new political group to get the US out of Afghanistan. He also says that “the ISI recently assassinated an Afghan in the Paktika province who knew the full extent of ISI’s collaboration with al-Qaeda.” [Time, 2/19/2002] He will similarly comment to journalist Kathy Gannon that bin Laden’s foreign fighters in Afghanistan “were all protected by the Taliban leadership, but their money and instructions came direction from Pakistan’s ISI.” [Gannon, 2005, pp. 161] Khaksar will continue to live in Afghanistan until early 2006, when he is apparently assassinated by the Taliban. [Washington Post, 1/15/2006]
A memorandum sent by the Justice Department to Department of Defense General Counsel William J. Haynes states that the military commissions intended to try enemy combatants are “entirely creatures of the president’s authority as commander in chief… and are part and parcel of the conduct of a military campaign.” [Office of Assistant Attorney General, 2/26/2002 ] This raises questions regarding the independence of the commissions. The US government will try the detainees itself, which is why Human Rights Watch later concludes, “Under the rules, the president, through his designees, serves as prosecutor, judge, jury, and, potentially, executioner.” [Human Rights Watch, 1/9/2004] Amnesty International will similarly criticize the fact that “the commissions will lack independence.” [Amnesty International, 10/27/2004] Trial by a court that is not in complete independence from a government acting as a prosecutor is a violation of the defendants’ human rights. Article 14(1) ICCPR [International Covenant on Civil and Political Rights] states: “In the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone shall be entitled to a fair and public hearing by a competent, independent, and impartial tribunal established by law.” Article 14(5) ICCPR furthermore grants “[e]verybody convicted of a crime… the right to his conviction and sentence being reviewed by a higher tribunal according to law.” But in the plans of the US government such a right is not foreseen. According to Human Rights Watch, “There is no appeal to an independent civilian court, violating a fundamental precept of international law as well as settled practice in the US military justice system.” [Human Rights Watch, 1/9/2004] The Justice Department memorandum advises that “incriminating statements may be admitted in proceedings before military commissions even if the interrogating officers do not abide by the requirements of Miranda.” The “Miranda warnings” are normally a prerequisite for allowing incriminating declarations by a defendant to the proceedings of a criminal trial.
In February 2002, the Belgian government secretly indicts Victor Bout, the world’s biggest illegal arms dealer, on charges of money laundering and illegal weapons trafficking. For the first time, he can be legally arrested and Interpol issues a secret arrest warrant for him anywhere in the world. Later that month, solid intelligence indicates Bout is going to be on a flight from Moldova to Greece. An encrypted message is sent by British intelligence field agents once the plane takes off, alerting their superiors in London that they are preparing to arrest Bout in Athens. But shortly after the message is sent, Bout’s plane veers away from its flight plan and disappears off radar screens into mountainous terrain. It reappears on radar about ninety minutes later and lands in Athens. British special forces raid the plane, but find it empty except for the pilot and a few passengers. One European intelligence official familiar with the operation will later say, “There were only two intelligence services that could have decrypted the British transmission in so short a time. The Russians and the Americans. And we know for sure it was not the Russians.” [Farah and Braun, 2007, pp. 202-203] It has been alleged that the US began secretly working with Bout shortly after 9/11, despite his previous connections to the Taliban (see Shortly After September 11, 2001).
Chief UN Inspector Hans Blix prepares a list of disarmament tasks that Iraq needs to complete in order prove its claim that it has no weapons of mass destruction. According to UN Resolution 1284, the completion of these tasks would make Iraq eligible for the suspension of sanctions. [Washington Post, 3/1/2003]

He will be captured in Faisalabad, Pakistan, in late March 2002 (see March 28, 2002). However, accounts on what intelligence leads to Zubaida’s location differ greatly:
Call to Yemen? - According to the Associated Press, “Pakistani intelligence officials have said quietly that a mobile phone call Abu Zubaida made to al-Qaeda leaders in Yemen led to his arrest.” [Associated Press, 4/20/2002] This could be a reference to the “Yemen hub,” an important al-Qaeda communication node in Yemen that has long been monitored by US intelligence. The hub is used until the middle of February 2002, when it is raided and shut down (see February 13, 2002).
Bribes Play Key Role? - According to books by Jane Mayer and Ron Suskind, Pakistani intelligence officers in Pakistan’s tribal region notice a caravan of vehicles carrying tall women wearing burqas who turn out to be male Islamist militants in disguise. According to Suskind’s version, the militants are arrested, but refuse to talk. According to Mayer’s version, the caravan is allowed to proceed. However, both authors agree that a bribe to the driver of one of the cars reveals that their destination is Faisalabad, Pakistan. Suskind adds that the driver gives up the name of a contact in Faisalabad, and that contact is found and reveals that Zubaida has arrived in town. US intelligence begins intensively monitoring Faisalabad. Afterwards, Mayer claims that the CIA buys the ISI’s help. A CIA source involved in the situation will later tell Mayer, “We paid $10 million for Abu Zubaida.” [Suskind, 2006, pp. 84; Mayer, 2008] In 2006, Pakistani President Pervez Musharraf will write in a memoir, “Those who habitually accuse us of not doing enough in the war on terror should simply ask the CIA how much prize money it has paid to the Government of Pakistan.” [Musharraf, 2006, pp. 190]
CIA Tracks Zubaida's Calls? - According to a 2008 New York Times article, in February 2002, the CIA learns that Zubaida is in Lahore or Faisalabad, Pakistani cities about 80 miles apart and with a combined population of over 10 million. The Times does not say how the CIA learns this. The CIA knows Zubaida’s cell phone number, although it is not explained how this was discovered either. (However, it had been reported elsewhere that Zubaida’s number had been monitored since at least 1998 (see October 1998 and After) and was still being monitored after 9/11 (see September 16, 2001 and After) and October 8, 2001).) Specialists use an electronic scanner that can track any operating cell phone and give its approximate location. However, Zubaida only turns his phone on briefly to collect messages, so his location cannot be pinpointed. A talented CIA official named Deuce Martinez gets involved. He posts a large, blank piece of paper on a wall, and writes Zubaida’s phone number in the middle of it. Then he and others add linked phone numbers, using the monitoring capabilities of the NSA and Pakistani intelligence. A map of Zubaida’s contacts grows. Eventually, Martinez and others are able to narrow Zubaida’s location down to 14 addresses in Lahore and Faisalabad, and these places are put under surveillance. Rather than wait any longer for more intelligence, all 14 locations are raided at once in a joint Pakistani-CIA operation on March 28, 2002, and Zubaida is found in one of the Faisalabad addresses. Key Call to Bin Laden or Al-Zawahiri? - Suskind’s book will also give the story of the CIA narrowing down the locations by monitoring local phone calls. He says that teams of CIA and FBI arrive in Faisalabad on March 17 for more intensive monitoring. Then, the key break comes near the end of the month, when two calls from a certain house in Faisalabad are made to phone numbers in Afghanistan that might be linked to Osama bin Laden or al-Qaeda number two leader Ayman al-Zawahiri. By this account, US intelligence already has a good idea which of the 14 locations Zubaida is in, because of those calls. [Suskind, 2006, pp. 87-89]
Explanations May Not Conflict - Note that these explanations do not necessarily conflict. For instance, bribes could have provided the lead that Zubaida was in Faisalabad, and then further CIA monitoring could have narrowed down his location there. Bribes also could have helped insure that Pakistani intelligence did not tip off Zubaida prior to the raid. The calls to Yemen and/or Afghanistan may have played a role along with other intelligence.
The CIA develops an innovative plan to gain intelligence about al-Qaeda in Afghanistan and Pakistan. The CIA would spend $80 million to create a new Afghan intelligence service in the new Afghan government. It would be staffed by Afghans but in reality would be “a wholly owned subsidiary of the CIA” with the orders being given by CIA officers. It would be much easier for Afghan operatives to slip into Pakistan and gain information about al-Qaeda operations than it would be for Americans to do so. But the plan is disrupted by the Bush administration’s focus on Iraq. Funding for the new service is repeatedly delayed and key personnel are redeployed to Iraq. [Risen, 2006, pp. 169-170]
In mid-March 2002, Deputy CIA Director John E. McLaughlin informs senior members of the president’s national security team that the CIA is cutting back operations in Afghanistan. Presumably the CIA there are to be used in Iraq instead. [Washington Post, 10/22/2004] Newsweek will later report that around this time, “The most knowledgeable CIA case officers, the ones with tribal contacts, were rotated out.” The CIA station chief in Kabul, Afghanistan, a fluent Arabic speaker and intellectual, is replaced by a highly unpopular chief who admits to only having read one book on Afghanistan. [Newsweek, 8/28/2007] More CIA personnel will move from Afghanistan to Iraq in late 2002 and early 2003 (see Late 2002-Early 2003).
CIA official Michael Scheuer will later say, “Clearly, by 2002 in the springtime, it was almost taken for granted that we were going to go to war with Iraq, in addition to having missed Osama bin Laden. It was a nightmare, and I know [CIA Director] Tenet was briefed repeatedly by the head of the bin Laden department that any invasion of Iraq would break the back of our counterterrorism program.” [PBS Frontline, 6/20/2006] Scheuer was head of the CIA’s bin Laden unit in the late 1990s and also leads a review of CIA intelligence on possible Iraq-al-Qaeda ties before the 2003 Iraq war (see (Before March 18, 2003)).
Saad bin Laden. [Source: NBC]In the spring on 2002, as the Taliban is collapsing in Afghanistan, many al-Qaeda operatives flee into neighboring Iran. About 20 to 25 operatives composing much of al-Qaeda’s management council are said to wind up in the custody of Iran’s Revolutionary Guard. Prior to this point, the Iranian government has been turning over most al-Qaeda captives to other countries, but after President Bush’s “Axis of Evil” speech criticizing Iran (see January 29, 2002), Iran decides to keep this group. [Washington Post, 7/9/2004] Iran does not officially admit to holding them, and their status is unclear, but they all seem to be living in a village near the Caspian Sea. One senior US intelligence official says, “They are under virtual house arrest,” and not able to do much. Those said to be in Iranian custody include:
Saif al-Adel, one of al-Qaeda’s top military commanders.
Suliman abu Ghaith, al-Qaeda spokesman.
Saad and Hamza bin Laden, two of Osama bin Laden’s young sons.
Abu Dahak, who served as al-Qaeda’s liaison to the rebels in Chechnya.
Mustafa Abu al-Yazid, a financial expert.
Two unnamed top aides to Ayman al-Zawahiri. [MSNBC, 6/24/205]
Thirwat Salah Shehata, a member of Islamic Jihad’s ruling council, who is probably one of the al-Zawahiri aides mentioned above. [MSNBC, 5/2005]
Mustafa Hamza, head of Al-Gama’a al-Islamiyya, an Egyptian militant group, and an al-Qaeda leader as well (see June 26, 1995). In late 2004, he will be extradited from Iran to stand trial in Egypt. [Reuters, 1/9/2005]
At first, these operatives appear to be capable of communicating with operatives outside of Iran. Saad bin Laden is said to play a major role planning the attack of a synagogue in Tunisia in April 2002 (see April 11, 2002). But the Saudi government will suspect that some of the operatives in Iran are involved in a 2003 attack in Riyadh, Saudi Arabia (see May 12, 2003), and they will successfully press Iran to tighten the house arrest of the operatives in Iran. Iran will propose an exchange of these prisoners around the time of the Riyadh bombing, but the US will reject the offer (see Mid-May 2003). Since that time, these leaders apparently remain in a state of limbo. CIA Director Porter Goss will say in 2005, “I think [the] understanding that there is a group of leadership of al-Qaeda under some type of detention—I don’t know exactly what type, necessarily—in Iran is probably accurate.” [MSNBC, 6/24/205] Michael Scheuer, former head of the CIA’s bin Laden unit, will later ask, “The question is, what does house arrest mean in the Iranian context?” He suggests that Iran could release the group or loosen their restrictions depending on how relations evolve between the US and Iran. “They’re a guarantee against bad behavior.” [Washington Post, 9/9/2007] In 2006, it will be reported that Saad bin Laden has been freed. [Reuters, 8/2/2006] Also in 2006, al-Yazid will emerge as a leader of al-Qaeda forces in Afghanistan and may never have been in Iran. [Washington Post, 9/9/2007] In 2007, the still teenaged Hamza bin Laden will reportedly appear in Afghanistan. [Associated Press, 9/11/2007] In 2008, it will be reported that the US still knows little about the al-Qaeda figures detained in Iran, but US officials say they believe Iran has largely kept them under control since 2003, limiting their ability to travel and communicate. One US official will say, “It’s been a status quo that leaves these people, some of whom are quite important, essentially on ice.” [ABC News, 5/29/2008]

There was no announcement to that effect, of course, but the intent was evident as the flow of officers sent to beef up the post-9/11 war against al-Qaeda ended and experienced Arabic-speaking officers were reassigned from CTC to Middle East posts (see Spring 2002) and to the task forces at CIA headquarters charged with preparing for the Iraq war.” [Scheuer, 2008, pp. 122] He will also say: “It was almost taken for granted that we were going to go to war with Iraq. It was a nightmare, and I know [CIA Director George] Tenet was briefed repeatedly by the head of the bin Laden department that any invasion of Iraq would break the back of our counterterrorism program.” [PBS Frontline, 3/24/2008]
Informants spot al-Qaeda number two leader Ayman al-Zawahiri in a medical clinic in Gardez, Afghanistan. Green Berets are located just five minutes away, but they are ordered to stand down so Navy SEAL Team Six can raid the clinic and capture or kill al-Zawahiri. But the SEAL team is apparently located much farther away and too much time elapses while they are preparing for the raid, allowing al-Zawahiri to escape. In 2004, the Washington Post will mention this as one of a series of incidents in which Green Berets units were passed over and opportunities to get important wanted men were lost. [Washington Post, 1/5/2004]
ABC News will later report that the first CIA secret prison is established in Thailand at this time to house Abu Zubaida, the first important al-Qaeda target who is captured at this time (see March 28, 2002). President Bush had recently authorized the creation of CIA prisons (see After February 7, 2002). After being captured in Pakistan and treated for gunshot wounds, Zubaida is flown to Thailand around the middle of April 2002 and housed in a small warehouse inside a US military base. He is waterboarded and interrogated (Mid-May 2002 and After). Later other secret prisons will open in other countries, such as Poland and Romania. [ABC News, 12/5/2005] This prison in Thailand apparently will close some time in 2003. [Washington Post, 11/2/2005] Some reports place the secret prison at the Voice of America relay station near the north-eastern Thai city of Udon Thani close to the border of Laos, but this is unconfirmed. [Sydney Morning Herald, 11/5/2005]
An al-Qaeda operations leader gives American al-Qaeda member Jose Padilla (see September-October 2000) an assignment: target high-rise buildings in the US that use natural gas. Padilla and al-Qaeda leaders consider buildings in Florida, Washington, DC, and New York City as potential targets. Though al-Qaeda leaders consider Padilla an incompetent (see Mid-April 2002), they give him $15,000 to begin putting together a plan. [Associated Press, 6/2004] Instead, Padilla will be captured by FBI agents as he comes into Chicago (see May 8, 2002).
Andrew Warren, a CIA officer later accused of date rape (see September 2007 and February 17, 2008), publishes a novel about Islamist terrorism, entitled The People of the Veil. The novel is set in Algeria during a radical uprising; the hero, Nick Philips, is an official at the US embassy who does battle with the local militant leader. [New York Beacon, 4/10/2002; Virginian-Pilot, 9/20/2002] There is also a love interest in the form of an Algerian woman named Miriam, who falls in love with Philips because he “respected her and treated her as an equal,” and “never pressured her and understood her culture.” [Newsweek, 1/31/2009] Warren discusses the reason for writing the book in media interviews: “I want to give a better portrayal of the Mideast’s culture, people, and Islam. For example, so many people think terrorists are crazy. They are not. They are fanatical, but they are very calculating and intelligent. And the rest of the people there, the 99.99 percent, are very warm and caring.” [Virginian-Pilot, 9/20/2002] He adds: “I wanted to teach people about the true meaning of Islam as well as explain how an Islamic terrorist views America and its influence on the Middle East. People shouldn’t assign guilt to every Muslim because of the recent attacks. Having worked and lived among Muslims in the Middle East for many years, I received an outpouring of condolences from my friends and former colleagues there after 9/11.” [New York Beacon, 4/10/2002] When publicizing the book, Warren portrays himself as an official of the State Department, not the CIA. [New York Beacon, 4/10/2002; Virginian-Pilot, 9/20/2002] Ironically, it is while serving as the CIA’s chief of station in Algeria that Warren will be accused of date-raping two Algerians. [Newsweek, 1/31/2009] It appears that Warren does not serve in Algeria with the CIA before the publication of the book, only in Iraq and Kuwait (see (1997)).

[Source: Rafiqur Rahman / Reuters / Corbis]The Al Haramain Islamic Foundation was founded in 1988 as a branch of the Muslim World League charity, and just like the Muslim World League it is closely linked to the Saudi government. It develops branches in about 50 countries, including a US branch based in Oregon. It has an annual budget of $40 million to $60 million, paid by the Saudi government, and about 3,000 employees. It gives considerable aid to religious causes such as building mosques. But by the early 1990s evidence began to grow that it was funding Islamist militants in Somalia and Bosnia, and a 1996 CIA report detailed its Bosnian militant ties (see January 1996). In 1998, several links were discovered between the charity and the African embassy bombings that year (see Autumn 1997 and 10:35-10:39 a.m., August 7, 1998).
In March 2002, the US and Saudi governments jointly announce the closing of Al Haramain’s branches in Somalia and Bosnia, but Al Haramain defiantly keeps its Bosnian branch open and it is shut down again after police raids in December 2003. [Washington Post, 8/19/2004; Burr and Collins, 2006, pp. 38-41] In December 2002, it is reported that the Somali branch is still open as well. [Christian Science Monitor, 12/18/2002]
In late 2002, Al Haramain is linked to the October 2002 Bali bombing and al-Qaeda operations in Southeast Asia in general (see September-October 2002).
In May 2003, Al Haramain announces the closing of its branches in Albania, Croatia, and Ethiopia, soon followed by branches in Kenya, Tanzania, Pakistan, and Indonesia. But this is because of pressure due to suspected militant links, and at least the Indonesian branch secretly changes locations and stays open. [Burr and Collins, 2006, pp. 38-41]
In late 2003, Al Haramain Director-General Aqeel al-Aqeel indiscreetly mentions that Saudi Crown Prince Abdullah recently donated money to his charity. Al-Aqeel, Deputy General Mansour al-Kadi, and two other senior officials are fired from the charity by the Saudi minister of religious affairs in January 2004. Interestingly, the Saudi minister is also the chairman of Al-Haramain’s board. In 1997, US intelligence found al-Kadi’s business card in the possession of Wadih el-Hage, Osama bin Laden’s former personal secretary (see Shortly After August 21, 1997). In February 2004, the US Treasury Department freezes the organization’s US financial assets pending an investigation.

In June 2001, Ahmed Alhaznawi visited the emergency room of Holy Cross Hospital in Fort Lauderdale, Florida, and was treated for a skin lesion. He was accompanied by Ziad Jarrah. In October 2001, after a series of mysterious anthrax attacks in the US became front-page news (see October 5-November 21, 2001), the treating doctor told the FBI he recognized the two hijackers and thought the wound was consistent with cutaneous anthrax exposure. However, the FBI discounted the possibility that the anthrax attacks originated with the hijackers or al-Qaeda. In March 2002, the New York Times reports that FBI spokesman John Collingwood “said the possibility of a connection between the hijackers and the anthrax attacks had been deeply explored. ‘This was fully investigated and widely vetted among multiple agencies several months ago… Exhaustive testing did not support that anthrax was present anywhere the hijackers had been.’” [New York Times, 3/23/2002] The FBI is criticized by the neoconservative Weekly Standard for focusing its investigation on a possible domestic perpetrator rather that Iraq or al-Qaeda: “Based on the publicly available evidence, there appears to be no convincing rationale for the FBI’s nearly exclusive concentration on American suspects. And the possibility is far from foreclosed that the anthrax bioterrorist was just who he said he was: a Muslim, impliedly from overseas.” [Weekly Standard, 4/29/2002] In March 2002 it is also reported that US forces in Afghanistan have discovered installations that could have been used by al-Qaeda to produce biological weapons. “US forces recently discovered a site near the southern Afghan city of Kandahar that appeared to be an al-Qaeda biological weapons lab under construction. At the lab, ‘there was evidence of the attempt, by bin Laden, to get his hands on weapons of mass destruction, anthrax, or a variety of others,’ Gen. Tommy Franks, head of the US Central Command, said… in an interview.” [CBS News, 3/23/2002] However, little new evidence will subsequently come out suggesting al-Qaeda was behind the October 2001 anthrax attacks.
Retired Lieutenant General Brent Scowcroft leads a presidential panel which proposes that control of the National Security Agency, the National Reconnaissance Office, and the National Imagery and Mapping Agency be transferred from the Department of Defense to the head of the CIA, the director of central intelligence (DCI). The plan is favored by the Congressional 9/11 joint inquiry but opposed by Defense Secretary Donald Rumsfeld and Vice President Dick Cheney. For years experts have argued that the US intelligence community’s 13 disparate agencies—“85 percent of whose assets reside in the Defense Department”—should be consolidated under the head of the CIA. Intelligence Community Still Focused on Cold War Needs, Scowcroft Finds - Scowcroft, the head of the Foreign Intelligence Advisory Board and a close friend and confidant of former President George H. W. Bush, actually revises a report he began before the 9/11 attacks. The report concludes that the US intelligence apparatus had been designed to meet the needs of the Cold War era and should now be overhauled. The 9/11 attacks are evidence of this, Scowcroft believes. The attacks came from rogue Islamist terrorists, not a superpower like China or the old USSR.
Opposition from Rumsfeld, Cheney - But, as Ron Suskind will write in his 2006 book The One Percent Doctrine, Rumsfeld is “strongly opposed” to Scowcroft’s idea, presumably because, by transferring control of the NSA from the Pentagon to the CIA, it would take power away from him. Scowcroft approaches Cheney with the dilemma. Scowcroft is well aware of Cheney and Rumsfeld’s long political partnership, and gives Cheney an easy out. If his proposals are overly “disruptive,” Scowcroft says, “I’ll just fold my tent and go away. I don’t want to… but I’ll be guided by you.” Cheney now has a choice. Knowing this is a battle Scowcroft will not win, he can either call Scowcroft off now and defuse a potential political conflict within the administration, or, in author Craig Unger’s words, he can “send Scowcroft off on a fool’s errand, pitting Bush 41’s close friend, as Suskind noted, against Bush 43’s cabinet secretary [Rumsfeld], who just happened to be Bush 41’s lifelong nemesis (see September 21, 1974 and After). Cheney chose the latter.” Cheney tells Scowcroft to “go ahead, submit the report to the president.” He knows President Bush will listen to Cheney and Rumsfeld’s advice and ignore the report. Unger later notes, “Scowcroft had once been Cheney’s mentor, his patron. Now the vice president was just humoring him.” [Unger, 2007, pp. 225-226]

While former ambassador Joseph Wilson is still in Africa learning about the supposed Iraq-Niger uranium deal (see February 21, 2002-March 4, 2002), Douglas Rohn, an analyst for the State Department’s Bureau of Intelligence and Research (INR), writes an intelligence assessment, titled “Niger: Sale of Uranium to Iraq Is Unlikely,” that disputes recent Italian intelligence reports (see October 15, 2001 and February 5, 2002) suggesting that Iraq attempted to purchase uranium from Niger. The assessment reiterates INR’s view that France controls the uranium industry and “would take action to block a sale of the kind alleged in a CIA report of questionable credibility from a foreign government service.” It adds that though “some officials may have conspired for individual gain to arrange a uranium sale,” Nigerien President Mamadou Tandja’s government would have been unlikely to risk relations with the US and other key aid donors. And it cites the logistical difficulties of a secret transaction requiring “25 hard-to-conceal 10-ton trailers” that would have had to travel 1,000 miles and cross one international border before reaching the sea. “A whole lot of things told us that the report was bogus,” Greg Thielmann, a high-ranking INR official, will later explain to Time magazine. “This wasn’t highly contested. There weren’t strong advocates on the other side. It was done, shot down.” The assessment, drafted in response to interest from the vice president’s office (see (February 13, 2002)), is sent to the White House Situation Room and Secretary of State Colin Powell. CIA officer John Kiriakou, who will later make a crucial intervention in the US debate on the ethics of waterboarding (see December 10, 2007), serves as the agency’s Counterterrorism Center chief in Pakistan. The date he is posted to this position is unknown, but he is involved in the capture of militant training camp facilitator Abu Zubaida in March 2002 (see March 28, 2002), and is transferred to Iraqi issues at headquarters in the summer of 2002 (see Summer 2002). The US intelligence community begins monitoring Lawrence Wright, a journalist and author who writes on counterterrorism. In addition to his articles for the New Yorker, in 2006 Wright publishes The Looming Tower, an account of the run-up to 9/11 which discloses the names of mid-level officials who performed badly. [Wright, 2006; New Yorker, 1/21/2008] Apparently, the surveillance begins when Wright calls a relative of al-Qaeda deputy leader Ayman al-Zawahiri. The relative, an architect in Cairo, had asked Wright if he knew whether all of al-Zawahiri’s children were dead after Wright published a profile of al-Zawahiri in the New Yorker. A source with the FBI (wrongly) told Wright that they were and that the information was not secret, so Wright passes the news on to the architect over the telephone. An intelligence community source will tell Wright that he later reads a transcript of this call. Wright will later say that he is surprised by this, because he thinks his part of the call should be anonimized under the Foreign Intelligence Surveillance Act as he is a US citizen. Before the publication of his book in 2006, Wright is visited at his home by FBI officials on the local Joint Terrorism Task Force. The officials ask him about calls he makes to a solicitor in Britain who is representing Islamist radicals Wright interviews for his book. During the visit, the FBI agents express the belief that it is Wright’s daughter who made the calls. It is unclear to Wright why they think this, as none of the home phones is in her name. Wright is troubled by this and around late 2007 will ask Director of National Intelligence Mike McConnell about it. McConnell will say that the call to the architect “shoud be” monitored and that Wright’s identity would have been deleted originally, as it could only be made available to the intelligence community after a legitimate request for it. “So here’s what I think—I’m guessing,” McConnell will say. “You called a bad guy, the system listened, tried to sort it out, and they did an intel report because it had foreign intelligence value. That’s our mission.” McConnell adds that the FBI would have to have had probable cause and a warrant to tap his phone and that he does not know how Wright’s daughter’s name could have come up. US troops investigate two dead bodies on March 17, 2002, as Operation Anaconda comes to a close. [Source: Joe Raedle/ Reuters]The US launches Operation Anaconda, a major offensive in Shah-i-Kot valley, near the town of Gardez, Afghanistan. About 2,000 US and allied soldiers attack a Taliban and al-Qaeda stronghold in the valley. The goal is to surround and cut off the Taliban and al-Qaeda from being able to retreat into Pakistan. Officially, the operation is hailed as an easy victory. For instance, Gen. Tommy Franks calls the operation “an unqualified and absolute success.” [Radio Free Europe, 3/20/2002] A Pentagon spokesperson calls the operation “a great success,” and says that of the hundreds or even thousands of enemy fighters trapped in the valley,“less than 100 escaped.” [New York Times, 3/14/2002] Up to 800 Taliban and al-Qaeda fighters are reported killed. [New York Times, 3/14/2002]
Unexpected Resistance - However, other accounts paint a different picture. The operation runs into unexpected resistance from the start, and eight US soldiers and a small number of allied Afghan fighters are killed in the first few days. The London Times later notes, “what was to have been a two-day operation stretched to 12.” Australian special forces troops who took part later say the operation was botched. “They blamed much of the problem on inadequate US air power, poor intelligence, and faulty technology.” [Radio Free Europe, 3/20/2002; London Times, 6/18/2002]
Militants Able to Escape - It appears that, as in Tora Bora, Afghan warlord armies supervised by a small number of US special forces, were given the key task of cutting off escape routes. At least one of the warlords involved had tricked the US military earlier in the war. “Although [Afghan] commanders insisted from the start of the campaign that the slopes were surrounded, [one Afghan commander] admitted that there had been at least one escape route” left open. The Guardian notes that “US troops spent weeks planning the attack on Shah-i-Kot, training and arming Afghan soldiers to prevent a repeat of the battle at Tora Bora,” but nonetheless, “nearly all the Taliban and al-Qaeda fighters appeared to have fled the area.” [Washington Post, 3/4/2002; Guardian, 3/15/2002] Most flee across the border into Pakistan (see December 2001-Spring 2002). The New York Times even reported that “some participants… said the Taliban had more or less come and gone as they pleased, visiting villagers in nearby towns.” [New York Times, 3/14/2002] One captured Taliban soldier who fought in the battle later claims that bin Laden made a brief personal appearance to rally his troops. [Newsweek, 8/11/2002] Only about 20 prisoners are captured and fewer than 20 bodies are found. [New York Times, 3/14/2002; New York Times, 3/18/2002] After retreating, the Taliban and al-Qaeda will change strategies and no longer attempt to congregate in Afghanistan in large numbers.
A few days after the State Department determines that the reported secret uranium deal between Iraq and Niger is “unlikely” (see March 1, 2002), former ambassador Joseph Wilson returns from his fact-finding trip to Niger (see February 21, 2002-March 4, 2002). Wilson tells CIA officials that he found no evidence to show that any such deal ever took place. [Unger, 2007, pp. 241] Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will later write that the debriefing actually begins shortly after Wilson’s arrival in the US, with “two clean-cut CIA officers, one of whom was the reports officer who had suggested sending Joe to Niger in the first place” (see February 13, 2002), arriving at the Wilson home, “clearly eager to debrief Joe so they could immediately write up an intelligence report on his trip.” Plame Wilson deliberately absents herself from the debriefing taking place in her living room, though she joins her husband and the two CIA officers for a late dinner of takeout Chinese food, where they discuss general subjects. [Wilson, 2004, pp. 29; Wilson, 2007, pp. 112] Based on Wilson’s information, the CIA’s Directorate of Operations (DO)‘s case officer writes a draft intelligence report and sends it to the DO reports officer, who adds additional relevant information from his notes. [US Congress, 7/7/2004] The report will be distributed by March 8, 2002 (see March 8, 2002). [Wilson, 2007, pp. 370]
Senior CIA case officer Valerie Plame Wilson (see April 2001 and After), whose husband, former ambassador Joseph Wilson, has recently returned from a trip to Africa to find out the facts behind the allegation that Iraq had attempted to buy uranium from Niger (see February 13, 2002), receives a copy of the final intelligence report written about her husband’s trip (see March 4-5, 2002). In her 2007 book Fair Game, Plame Wilson says she receives the report “as a simple courtesy [from] the reports officer” who had suggested Wilson journey to Niger and investigate the allegations. Plame Wilson will recall the report as being “a couple of pages long and fairly straightforward, in the typical bland style of such reports.” She reads the report, makes “no changes,” and gives it back to the reports officer. [Wilson, 2007, pp. 113]
Moazzam Begg. [Source: Kieran Doherty / Reuters]According to a later habeas petition, a Pakistani court orders the Pakistani interior minister to produce Moazzam Begg before the court on March 7, which the minister refuses to do. On March 14, the court again orders the minister to produce Begg, this time under threat of sanctions. Again, the interior minister refuses to comply with the order. Meanwhile, Begg’s lawyer Abdur Rahman Saddiqui claims that Pakistan’s intelligence agency (ISI) and the CIA have captured Begg and that the ISI is interrogating him. The CIA sends a one-and-a-half-page cable to the White House, the FBI, the Justice Department, the Joint Chiefs of Staff, and the Defense Intelligence Agency, with news that a CIA source sent to Niger has failed to find any evidence to back claims that Iraq sought uranium from that country (see February 21, 2002-March 4, 2002). The cable contains an initial report of the source’s findings in Niger. [Knight Ridder, 6/12/2003; ABC News, 6/12/2003; Knight Ridder, 6/13/2003; Washington Post, 6/13/2003; BBC, 7/8/2003; BBC, 7/8/2003; US Congress, 7/7/2004] The agency rates the quality of the information in the report as “good,” with a rating of 3 out of 5. Caveats and Denials - The report does not name the CIA source or indicate that the person is a former ambassador. Instead it describes the source as “a contact with excellent access who does not have an established reporting record” and notes that the Nigeriens with whom he spoke “knew their remarks could reach the US government and may have intended to influence as well as inform.” A later Senate report on the US’s pre-war intelligence on Iraq will state: “The intelligence report indicated that former Nigerien Prime Minister Ibrahim Mayaki was unaware of any contracts that had been signed between Niger and any rogue states for the sale of yellowcake while he was prime minister (1997-1999) or foreign minister (1996-1997). Mayaki said that if there had been any such contract during his tenure, he would have been aware of it.” Mayaki, according to the report, also acknowledged a June 1999 visit (see June 1999) by a businessman who arranged a meeting between Mayaki and an Iraqi delegation to discuss “expanding commercial relations” between Niger and Iraq. The intelligence report says that Mayaki interpreted “expanding commercial relations” to mean that the delegation wanted to discuss purchasing uranium. The meeting did take place, but according to the report, “Mayaki let the matter drop due to UN sanctions on Iraq.” The intelligence report also says that Niger’s former Minister for Energy and Mines, Mai Manga, told Wilson that there have been no sales outside of International Atomic Energy Agency (IAEA) channels since the mid-1980s. Mai Manga is also reported to have described how the French mining consortium controls Nigerien uranium mining and keeps the uranium very tightly controlled from the time it is mined until the time it is loaded onto ships in Benin for transportation overseas. Manga said he believed it would be difficult, if not impossible, to arrange a special clandestine shipment of uranium to a country like Iraq. [US Congress, 7/7/2004]
White House: Report Left Out Details, Considered Unimportant - Bush administration officials will say in June 2003 that the report left out important details, such as the trip’s conclusions. And consequently, the Washington Post will report in June 2003, “It was not considered unusual or very important and not passed on to Condoleezza Rice, the president’s national security adviser, or other senior White House officials.” [Washington Post, 6/12/2003 ; Washington Post, 6/13/2003; Knight Ridder, 6/13/2003]
CIA Source Doubts White House Claims - But the CIA source who made the journey, former ambassador Joseph Wilson, will find this explanation hard to believe. “Though I did not file a written report [he provided an oral briefing (see March 4-5, 2002)], there should be at least four documents in United States government archives confirming my mission,” he will later explain. “The documents should include the ambassador’s report of my debriefing in Niamey, a separate report written by the embassy staff, a CIA report summing up my trip, and a specific answer from the agency to the office of the vice president (this may have been delivered orally). While I have not seen any of these reports, I have spent enough time in government to know that this is standard operating procedure.” [New York Times, 7/6/2003]
Senior CIA Case Officer Backs Up Source - In 2007, Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will write of the report (see March 4-5, 2002) that if standard protocol has been followed, the report is distributed to “all the government departments that have intelligence components, such as the State Department’s Bureau of Intelligence and Research (INR), the National Security Agency (NSA), the Pentagon, and the overseas military commands. All of us had every reason to believe that their finished report would indeed be sent to the vice president’s office as part of the established protocol.” According to Plame Wilson, who read the report when it was completed (see (March 6, 2002)), much of the report focuses on “Niger’s strict, private, and government controls on mining consortia to ensure that no yellowcake went missing between the uranium mines and the marketplace.” She will write in 2007 that her husband’s report “corroborated and reinforced what was already known.” Both she and her husband assume that the allegations are sufficiently disproven and will not be heard of again. [Wilson, 2007, pp. 112-114]
Little New Information - According to intelligence analysts later interviewed by Congressional investigators, the intelligence community does not believe the trip has contributed any significant information to what is already known about the issue, aside from the details of the 1999 Iraqi delegation. Speaking in regard to media reports of the Defense Department’s new Nuclear Posture Review (NPR) (see December 31, 2001), the Defense Department issues a statement downplaying its meaning. The statement reads in part: “We will not discuss the classified details of military planning or contingencies, nor will we comment on selective and misleading leaks. The Nuclear Posture Review is required by law. It is a wide-ranging analysis of the requirements for deterrence in the 21st century. This review of the US nuclear posture is the latest in a long series of reviews since the development of nuclear weapons. It does not provide operational guidance on nuclear targeting or planning. The Department of Defense continues to plan for a broad range of contingencies and unforeseen threats to the United States and its allies. We do so in order to deter such attacks in the first place. Of particular significance in the new Nuclear Posture Review is President Bush’s decision to reduce operationally deployed strategic nuclear weapons by two-thirds, a decision made possible by the new strategic relationship with Russia.” [Federation of American Scientists, 3/9/2002] The Defense Department is being deceptive in its attempt to downplay the NPR, which in fact is a new operational policy that plans for pre-emptive nuclear strikes against countries attempting to create weapons of mass destruction, if the White House deems such strikes necessary. Homeland Security Director Tom Ridge admits that the FBI has failed to find a single al-Qaeda cell operating in the US. He suspects there are active cells, but cannot explain why none have been caught. [London Times, 3/11/2002] Seemingly obvious al-Qaeda cells, such as Nabil al-Marabh’s Boston cell (see June 27, 2004) and Ali Mohamed’s Santa Clara, California, cell (see Mid-1990s), appear to have escaped detection or public mention. The FBI will issue a report in 2005 that again will claim that no sleeper cells can be found in the US (see February 2005). On September 12, 2001, the New York Times reported, “Authorities said they had also identified accomplices in several cities who had helped plan and execute Tuesday’s attacks. Officials said they knew who these people were and important biographical details about many of them.” [New York Times, 9/13/2001]
Jay Bybee, the chief of the Justice Department’s Office of Legal Counsel (OLC), issues a classified memo to William Howard Taft IV, the chief counsel of the State Department, titled “The President’s Power as Commander in Chief to Transfer Captive Terrorists to the Control and Custody of Foreign Nations.” The memo, actually written by Bybee’s deputy John Yoo, says Congress has no authority to block the president’s power to unilaterally transfer detainees in US custody to other countries. In essence, the memo grants President Bush the power to “rendition” terror suspects to countries without regard to the law or to Congressional legislation, as long as there is no explicit agreement between the US and the other nations to torture the detainees. [US Department of Justice, 3/12/2002 ; Savage, 2007, pp. 148; American Civil Liberties Union [PDF], 1/28/2009 ; New York Times, 3/2/2009] The memo directly contradicts the 1988 Convention Against Torture (see October 21, 1994), which specifically forbids the transfer of prisoners in the custody of a signatory country to a nation which practices torture. Once the treaty was ratified by Congress in 1994, it became binding law. But Yoo and Bybee argue that the president has the authority as commander in chief to ignore treaties and laws that supposedly interfere with his power to conduct wartime activities. [Savage, 2007, pp. 148-149] In 2009, when the memos are made public (see March 2, 2009), Jennifer Daskal of Human Rights Watch says she is shocked at the memo: “That is [the Office of Legal Counsel] telling people how to get away with sending someone to a nation to be tortured. The idea that the legal counsel’s office would be essentially telling the president how to violate the law is completely contrary to the purpose and the role of what a legal adviser is supposed to do.” [Washington Post, 3/3/2009]
