Lewis Libby’s legal team announces that it intends to call a psychology professor to testify that Libby did not deliberately lie to the FBI (see October 14, 2003 and November 26, 2003) and to the grand jury (see March 5, 2004 and March 24, 2004), but merely made misstatements due to memory failure. In a court filing, the lawyers write, “Mr. Libby will show that the snippets of conversation at issue in this case took place amid a rush of pressing national security matters that commanded his attention throughout his long and stressful work day” (see January 31, 2006). The witness is Robert Bjork, a memory expert from UCLA. The lawyers say Bjork will explain that, contrary to what jurors may think, “memory does not function like a tape recorder, with memories recorded, stored, and played back verbatim.” Cornell University professor Ulric Neisser says the so-called “memory defense” that Libby’s team intends to mount may be effective. Referring to Libby’s claim that he learned of outed CIA agent Valerie Plame Wilson from a reporter (see 12:00 p.m. June 11, 2003, 2:00 p.m. June 11, 2003, 5:27 p.m. June 11, 2003, (June 12, 2003), and July 10 or 11, 2003), Neisser says, “If everything hinges on who he learned it from first, people do forget that stuff all the time.” [US District Court for the District of Columbia, 7/31/2006 ; US District Court for the District of Columbia, 7/31/2006 ; Associated Press, 8/1/2006; New York Sun, 8/1/2006] Criminal defense lawyer Jeralyn Merritt, following the trial at the progressive blog TalkLeft, calls the use of a memory expert entirely appropriate, but notes: “The expert only should be allowed to explain the principles of memory and memory failure to the jury. He should not be allowed to render an opinion as to whether Libby’s memory failed since that’s the ultimate question for the jury to decide.” [Jeralyn Merritt, 8/1/2006]

Geisbert / USAMRIID]In August 2006, an article by Douglas Beecher is published in Applied and Environmental Microbiology, a well-respected peer-reviewed scientific journal. Beecher is a microbiologist in the FBI’s hazardous materials response unit who has been working on the FBI’s investigation of the 2001 anthrax attacks since the investigation began. His article represents the first official FBI explanation about the anthrax used in the attacks. Releasing the evidence in a peer-reviewed journal will give it more credence if cited in a later court trial. [Chemical and Engineering News, 12/4/2006] At first, the article is little-noticed by the media, but the Washington Post will highlight it in a front-page story a month later. The Post will also say that others in the FBI have come to the same conclusions Beecher has. [Washington Post, 9/25/2006]
Controversial Paragraph - Beecher focuses on the anthrax letter mailed to Sen. Patrick Leahy (D-VT), since it had never been opened and thus remained the least contaminated. The anthrax in the Leahy letter and the letter to Sen. Tom Daschle (D-SD) has been considered deadlier than the other anthrax letters because victims were infected by inhalation and not just by touch. Most controversially, Beecher states that a “widely circulated misconception is that the spores were produced using additives and sophisticated engineering supposedly akin to military weapon production.” Up until this time, it had been widely reported that these two letters had been “weaponized,” meaning the anthrax in them had been coated with a substance (usually reported as silicia) to make it float in the air and thus deadlier to handle.
No Supporting Evidence - But while Beecher makes this surprising claim, he gives no evidence to back it up. The comment is made in passing in the discussion section of the article and there are no footnotes or explanation related to it. Several months later, L. Nicholas Ornston, editor-in-chief of the microbiology journal, says, “The statement should have had a reference. An unsupported sentence being cited as fact is uncomfortable to me. Any statement in a scientific article should be supported by a reference or by documentation.” Beecher and the rest of the FBI make no further public comments to support his assertion, but the FBI begins describing the anthrax as non-weaponized from this point onwards.
Highly Pure Anthrax, but No Coating or Milling - Several months later, two scientists will claim they saw the anthrax from one of these letters not long after the attacks and did not see any signs of coating or milling. However, what they did see was an exceptionally high purity to the anthrax, in which the high level of debris in the earlier anthrax letters was removed, making it deadlier and possibly more able to float through air. After prosecutors in Milan, Italy, charge a group of US officials with involvement in the kidnap of Islamist extremist Hassan Mustafa Osama Nasr (a.k.a. Abu Omar—see Noon February 17, 2003), public defenders are appointed for them. However, the US government bars the CIA officials among the accused, who will eventually number 25, from talking to their defenders. [Congressional Quarterly, 8/28/2009]
The US and UN finally officially designates the Philippines and Indonesian branches of the International Islamic Relief Organization (IIRO) as a financier of terrorism. Abdul Al-Hamid Sulaiman Al-Mujil, executive director of the IRRO’s far east division, is similarly designated as well. The IIRO is a major charity connected to the Saudi government that has long been suspected of financing Islamic militant groups (see January 1996). It was reported shortly after 9/11 that the US left the IIRO off a list of designated terrorism financiers so as to not embarrass the Saudi government (see October 12, 2001). The Philippine IIRO branch in particular has been publicly accused of funding al-Qaeda since the mid-1990s, due to the activities of Mohammed Jamal Khalifa, bin Laden’s brother-in-law who headed that branch when he funded the Bojinka plot in the early 1990s (see 1987-1991). [Associated Press, 8/3/2006; Manila Times, 12/12/2006] A US Treasury Department press release says Al-Mujil has been nicknamed the “million dollar man” for his “long history of providing support to terrorist organizations.” He is accused of funding the Abu Sayyaf group in the Philippines and Jemaah Islamiyah in Indonesia. He is said to have had relationships with bin Laden and Khalid Shaikh Mohammed. The press release also calls “a senior al-Qaeda member” and accuses the current director of the IIRO’s Philippine branch, Abd al-Hadi Daguit, “a trusted associate of Khalifa.” But curiously, Khalifa himself is still not officially listed, nor is Daguit. He will die in mysterious circumstances several months later. [Treasury Department, 8/3/2006]
Rashid Rauf. [Source: Warrick Page/ Getty Images]British police arrest 24 people in connection with a plot to blow up aircraft flying from Britain to the United States. Metropolitan Police Deputy Commissioner Paul Stephenson says the plot was “intended to be mass murder on an unimaginable scale.” [CNN, 8/10/2006] Secretary of Homeland Security Michael Chertoff describes the plot as “well-advanced and well-thought-out and… really resourced to succeed.” [MSNBC, 8/10/2006] He also likens it to the foiled 1995 Bojinka plot, one portion of which involved blowing up up to a dozen airplanes over the ocean using liquid explosives smuggled onto the planes. [CNN, 8/11/2006] The British threat warning level is raised to critical and London’s Heathrow Airport is closed to most European flights. US officials say the plot involved hiding liquid explosives in carry-on luggage, and up to 12 flights would have been targeted. A senior US congressional source says the plotters planned to carry sports drinks onto the flights, which would then be mixed with a gel-like substance. The explosives would be triggered by the electrical charge from an iPod or mobile phone. Administration officials say the plot involved British Airways, Continental, United, and American Airlines. The plotters intended to detonate the devices over New York, Washington, San Francisco, Boston, and Los Angeles. Officials say the plot demonstrates “very strong links to al-Qaeda” and was nearly operational. In the US, the Department of Homeland Security raises the terror threat to the highest level, red, meaning “severe,” for commercial flights originating in Britain and bound for the US. In addition, the threat level is raised to orange, or “high,” for all commercial flights operating in or coming to the US. [CNN, 8/10/2006] British officials say the death toll could have exceeded the 2,700 of the September 11 attacks, with one source calling the plot “our 9/11.” The arrests were spurred by the detention in Pakistan of one of the plotters, Rashid Rauf. The Pakistanis arrested him at the behest of US Vice President Dick Cheney (see Before August 10, 2006 and Between July 28 and August 9, 2006). [Guardian, 8/11/2006] Officials say some plotters already had tickets for flights and planned to stage test runs over the weekend. Despite the 24 arrests, five suspects in Britain are still being urgently hunted. One official says, “They didn’t get them all.” But British officials claim the arrests in London and Birmingham snare all the alleged “main players.” [MSNBC, 8/10/2006] British Home Secretary John Reid says the operation is ongoing and more arrests may be made. US officials say the suspects are all British citizens between the ages of 17 and 35, with some being of Pakistani ethnicity. They add that some of the suspects had been monitored by British intelligence for several months. Deputy Assistant Commissioner Peter Clarke, head of the Metropolitan Police Service Anti-Terrorist Branch, says the arrests follow an “unprecedented level of surveillance” over several months involving meetings, movements, travel, spending, and the aspirations of a large group of people. Liquids, Gels, Electronics Banned from Flights - Homeland Security bans all liquids and gels except baby formula and prescription medications in the name of the ticket holder in carry-on luggage on all flights. Passengers traveling from and through British airports are temporarily permitted to only carry-on items on a restricted list. These items have to be carried in transparent plastic bags. No liquids can be carried on board, including liquid medications “unless verified as authentic.” All electronic items are also banned. [Detroit Free Press, 8/10/2006]
Arrests, Alert Questioned - In the days following the security operation, the arrests will meet with some skepticism. Stephen Glover of the Daily Mail points to previous baseless terror scares in the US and Britain, as well as questioning the political motivations of the home secretary. [Daily Mail, 8/16/2006] Douglas Fraser of the Herald in Edinburgh suggests the “political component” of the operation has caused skepticism. He says the intelligence services are taking credit for foiling a major plot by “ramping up the level of public concern about the threat.” He notes that the timing coincides with an attempt by the government of Prime Minister Tony Blair to return to an issue it was defeated on before: increasing to 90 days the amount of time that people can be detained without charge in the case of alleged terrorist offenses. [VOA News, 8/18/2006] Sean O’Neill and Stewart Tendler of the London Times urge the public and the media to wait for solid evidence before accepting the version of events presented by the government. They say previous bungled anti-terror operations have put pressure on the authorities to build a solid case in public. [London Times, 8/12/2006] In response to these criticisms, intelligence services will be hesitant to release much information publicly, but confirm to The Guardian that surveillance and tips from informants pointed to a plot in the making. Police identify the explosives to be used in the plot as TATP (triacetone triperoxide) and HMTD (hexamethylene triperoxide diamine), both peroxide-based liquid explosives. [Guardian, 8/19/2006] Police will also reveal that the raids uncovered jihadist materials, receipts of Western Union money transfers, seven martyrdom videos, and the last will and testament of one plotter. [New York Times, 8/28/2006]
Some Suspects to Be Released; Security Measures Probably Unnecessary - However, The Guardian does indicate that some of the arrested suspects are likely to be released and that the security measures instituted following the arrests are almost certainly unnecessary. [Guardian, 8/19/2006] Contradicting earlier reports, a senior British official will suggest an attack was not imminent, saying the suspects had not yet purchased any airline tickets. In fact, some do not even have passports. [MSNBC, 8/14/2006] Over two and a half weeks after the arrests, a target date for the attacks and number of planes involved will still be undetermined by investigators. The estimate of 10 to 12 planes is characterized by officials as speculative and exaggerated. Clarke acknowledges the police are still investigating “the number, destination, and timing of the flights.” [New York Times, 8/28/2006]
12 Suspects to Be Tried - Twelve suspects will be charged with terrorism offences near the end of August 2006. Trials are expected to start in January 2008 at the earliest. Prosecutor Colin Gibbs says he expects “a very long trial of [between] five and eight months.” [IOL, 9/4/2006]

The CIA provides short summaries of Vice President Dick Cheney’s daily security briefings to defense attorneys for Cheney’s indicted former chief of staff, Lewis Libby. The documents are provided as per a March court order (see March 10, 2006). They have been turned over in batches since May 2006; the final documents have just been turned over. The briefing summaries cover the period in the summer of 2003 when Libby was allegedly discussing Valerie Plame Wilson’s CIA identity with journalists. They also cover several weeks in the fall of 2003 when Libby was questioned by the FBI (see October 14, 2003 and November 26, 2003), and March 2004 when Libby testified before a federal grand jury (see March 5, 2004 and March 24, 2004). Harun Shirzad al-Afghani. [Source: Defense Department]Harun Shirzad al-Afghani is an alleged veteran Islamist militant held in Guanatanamo prison starting in 2007. His Guantanamo file will later be leaked to the public, and it states that he is believed to have attended an important meeting of militant groups on August 11, 2006. A letter found with al-Afghani explains that the meeting is meant to bring together senior figures in the Taliban, al-Qaeda, Lashkar-e-Toiba (a Pakistani militant group), and Hezb-i-Islami (another militant group, led by Gulbuddin Hekmatyar). But most interestingly, the file claims that senior Pakistani military and ISI (intelligence) officials also attend the meeting. The meeting discusses coordination of attacks against US-led forces in Afghanistan. Plans are made to “increase terrorist operations” in certain Afghanistan provinces, including suicide bombings, assassinations, and mines. Al-Afghani also allegedly tells his Guantanamo interrogators that in 2006 an unnamed ISI officer pays an Islamist militant a large sum of money to transport ammunition into Afghanistan to help al-Qaeda, the Taliban, and Hezb-e-Islami. Al-Afghani’s file describes him as a leader both in al-Qaeda and Hezb-e-Islami, with links to important leaders in both groups predating the 9/11 attacks. [Source: Citizens for Responsibility and Ethics in Washington]Joseph and Valerie Plame Wilson name new counsel for their lawsuit against Vice President Dick Cheney, White House political strategist Karl Rove, and former White House official Lewis Libby (see July 13, 2006). The Wilsons have engaged the non-profit, public interest organization Citizens for Responsibility and Ethics in Washington (CREW) as successor counsel. They have also engaged Washington attorneys Joseph Cotchett and Frank Pitre to represent them at trial. Duke University law professor Erwin Chemerinsky remains as co-counsel. [Citizens for Responsibility and Ethics in Washington, 8/15/2006] Cheney also retains counsel for the lawsuit. He hires Emmet T. Flood, a Washington lawyer who helped defend former President Bill Clinton during Clinton’s impeachment trial. Though Flood defended Clinton, a Democrat, he has donated money only to Republican political candidates. [TPM Muckraker, 8/15/2006]
Federal district court judge Anna Diggs Taylor rules that the NSA’s warrantless wiretapping program (see Early 2002) is unconstitutional and orders it ended. She amends her ruling to allow the program to continue while the Justice Department appeals her decision. The decision is a result of a lawsuit filed by the American Civil Liberties Union (ACLU) and other civil liberties groups. Taylor rules that the NSA program violates US citizens’ rights to privacy and free speech, the Constitutional separation of powers among the three branches of government, and the Foreign Intelligence Surveillance Act (see 1978). Taylor writes: “It was never the intent of the framers to give the president such unfettered control, particularly where his actions blatantly disregard the parameters clearly enumerated in the Bill of Rights. There are no hereditary Kings in America and no powers not created by the Constitution. So all ‘inherent powers’ must derive from that Constitution.” [Verdict in ACLU et al v. NSA et al, 8/17/2006 ; Washington Post, 8/18/2006] The program “violates the separation of powers doctrine, the Administrative Procedures Act, the First and Fourth amendments to the United States Constitution, the FISA and Title III,” Taylor writes, and adds, “[T]he president of the United States… has undisputedly violated the Fourth in failing to procure judicial orders.” [CNN, 8/17/2006]
Judge Lets One Portion Stand - Taylor rejects one part of the lawsuit that seeks information about the NSA’s data mining program (see October 2001), accepting the government’s argument that to allow that portion of the case to proceed would reveal state secrets (see March 9, 1953). Other lawsuits challenging the program are still pending. Some legal scholars regard Taylor’s decision as poorly reasoned: national security law specialist Bobby Chesney says: “Regardless of what your position is on the merits of the issue, there’s no question that it’s a poorly reasoned decision. The opinion kind of reads like an outline of possible grounds to strike down the program, without analysis to fill it in.” The White House and its Republican supporters quickly attack Taylor, who was appointed to the bench by then-President Jimmy Carter, as a “liberal judge” who is trying to advance the agenda of Congressional Democrats and “weaken national security.” For instance, Senator Mike DeWine (R-OH) says that halting the program “would hamper our ability to foil terrorist plots.” [Washington Post, 8/18/2006]
Democrats, Civil Libertarians Celebrate Ruling - But Democrats defend the ruling. For instance, Senator John Kerry (D-MA) says the ruling provides a much-needed check on the unfettered power of the Bush White House. “[N]o one is above the law,” says Kerry. [Washington Post, 8/18/2006] Lawyers for some of the other cases against the NSA and the Bush administration laud the decision as giving them vital legal backing for their own court proceedings. “We now have a ruling on the books that upholds what we’ve been saying all along: that this wiretapping program violates the Constitution,” says Kevin Bankston, who represents the Electronic Frontier Foundation (EFF) in its class-action case against AT&T for its role in the NSA’s surveillance program (see January 31, 2006). [Washington Post, 8/18/2006] Legal expert and liberal commentator Glenn Greenwald writes that Taylor’s ruling “does not, of course, prohibit eavesdropping on terrorists; it merely prohibits illegal eavesdropping in violation of FISA. Thus, even under the court’s order, the Bush administration is free to continue to do all the eavesdropping on terrorists it wants to do. It just has to cease doing so using its own secretive parameters, and instead do so with the oversight of the FISA court—just as all administrations have done since 1978, just as the law requires, and just as it did very recently when using surveillance with regard to the [British] terror plot. Eavesdropping on terrorists can continue in full force. But it must comply with the law.” Greenwald writes: “[T]he political significance of this decision cannot be denied. The first federal court ever to rule on the administration’s NSA program has ruled that it violates the constitutional rights of Americans in several respects, and that it violates criminal law. And in so holding, the court eloquently and powerfully rejected the Bush administration’s claims of unchecked executive power in the area of national security.” [Salon, 8/17/2006]
White House Refuses to Comply - The Bush administration refuses to comply with Taylor’s ruling, asserting that the program is indeed legal and a “vital tool” in the “war on terrorism.” It will quickly file an appeal, and law professors on both sides of the issue predict that Taylor’s ruling will be overturned. Lawsuit Ends with White House 'Compromise' - The lawsuit will end when the White House announces a “compromise” between the wiretapping program and FISC (see January 17, 2007).

The Office of the Director of National Intelligence (ODNI) announces that Intelligence Director John Negroponte has appointed J. Patrick Maher as a new acting mission manager to collect “timely and accurate intelligence” on Cuba and Venezuela. Maher, who will continue to serve his current position as National Intelligence Officer for the Western Hemisphere, is a Latin American specialist and has been with the CIA since 1974. The appointment was made shortly after news surfaced on July 31 that Fidel Castro was in the hospital and that his brother Raul Castro had temporarily taken over. According to a statement released by the ODNI, this task is “critical” because “policy-makers have increasingly focused on the challenges” that the two countries “pose to American foreign policy.” Iran and North Korea are the only other countries for which there are currently mission managers. Judge Reggie Walton issues a court order that withholds certain “extremely sensitive” classified documents from the Lewis Libby defense team. Walton writes that he “carefully reviewed” the requests from special counsel Patrick Fitzgerald and from the CIA to withhold the documents. The documents were provided to him ex parte and in camera, and Walton determined that they were irrelevant to the Libby defense efforts. Walton writes that the documents are “extremely sensitive and their disclosure could cause serious if not grave damage to the national security of the United States.” Walton has previously allowed other classified documents to be provided to Libby, and the CIA has provided documents requested by Libby that Walton has released to the defense (see December 14, 2005, January 9, 2006, January 20, 2006, January 23, 2006, January 23, 2006, January 31, 2006, (February 16, 2006), February 21, 2006, February 24, 2006. February 27, 2006, March 1, 2006, March 2-7, 2006, March 10, 2006, March 17, 2006, April 5, 2006, May 3, 2006, May 12, 2006, May 19, 2006, and June 2, 2006). Many of the documents provided to Libby are redacted versions or summaries of the classified documents he viewed during his morning intelligence briefings. [MSNBC, 8/18/2006] Former prosecutor Christy Hardin Smith, writing for the progressive blog FireDogLake, writes of Walton’s decision: “That there is material so sensitive in this case that Libby is not entitled to it at all… speaks volumes to me in terms of what was endangered by him and Karl Rove opening their yaps in order to exact some political payback and CYA for Dick Cheney and the Bush administration. Putting personal political fortune ahead of the security of the entire United States during a time of armed conflict to cover your bosses’ *sses for lying the nation into war? Now THAT is unpatriotic.” [Christy Hardin Smith, 8/19/2006]
Former 9/11 Commission co-chair Lee Hamilton. [Source: CBC]Lee Hamilton, the former co-chair of the 9/11 Commission, gives a wide-ranging interview to the CBC about Without Precedent, a book he recently co-authored about his time on the 9/11 Commission (see August 15, 2006). In the interview he discusses the various “conspiracy theories” surrounding the events of 9/11. The interviewer, Evan Solomon, mentions to him a recent Zogby poll (see May 17, 2006) that found that 42% of Americans agreed that “the US government, and its 9/11 Commission, concealed or refused to investigate critical evidence that contradicts the official explanation of September 11th.” Hamilton calls this lack of trust in the Commission’s report “dispiriting,” but attacks the “conspiracy theory people,” saying, “when they make an assertion they do it often on very flimsy evidence.” He addresses some of the various “conspiracy theories” that have been put forward about 9/11:
In order to contradict the allegation that the Twin Towers were brought down deliberately with pre-planted explosives, Hamilton says the WTC collapsed (see 8:57 a.m. September 11, 2001) because “the super-heated jet fuel melted the steel super-structure of these buildings and caused their collapse.” He adds, “There’s a powerful lot of evidence to sustain that point of view, including the pictures of the airplanes flying into the building.”
With regard to the collapse of WTC Building 7 (see (5:20 p.m.) September 11, 2001), which some people claim was also caused by explosives, he argues, “[W]e believe that it was the aftershocks of these two huge buildings in the very near vicinity collapsing. And in the Building 7 case, we think that it was a case of flames setting off a fuel container, which started the fire in Building 7, and that was our theory on Building 7.” However, the interviewer points out that the 9/11 Commission’s final report does not actually mention the collapse of Building 7, and Hamilton says he does not recall whether the Commission made a specific decision to leave it out.
In reply to a question about why the debris of Building 7 were moved quickly from the scene without a thorough investigation, even though nobody died in Building 7 and there was no need for rescue operations there, Hamilton responds, “You can’t answer every question when you conduct an investigation.”
When asked whether Saeed Sheikh sent Mohamed Atta $100,000 for the 9/11 plot (see Early August 2001 and Summer 2001 and before), Hamilton replies, “I don’t know anything about it.” When the interviewer presses him about whether the Commission investigated a possible Pakistani Secret Service (ISI) connection to the attacks, Hamilton replies, “They may have; I do not recall us writing anything about it in the report. We may have but I don’t recall it.”
Asked about Secretary of Transportation Norman Mineta’s claim that Vice President Dick Cheney was in the presidential bunker beneath the White House at 9:20 a.m. on 9/11 (see (Between 9:20 a.m. and 9:27 a.m.) September 11, 2001), almost 40 minutes earlier than the Commission claimed he had arrived there, Hamilton replies, “I do not recall.” When pressed, he expands, “Well, we think that Vice President Cheney entered the bunker shortly before 10 o’clock. And there is a gap of several minutes there, where we do not really know what the Vice President really did. There is the famous phone call between the President and the Vice President. We could find no documentary evidence of that phone call.”
When the interviewer points out that Richard Clarke’s account conflicts with the Commission’s over what time authorization was received from Dick Cheney to shoot down Flight 93 (see (Between 9:45 a.m. and 9:56 a.m.) September 11, 2001 and (Between 10:00 a.m. and 10:15 a.m.) September 11, 2001), Hamilton retorts, “Look, you’ve obviously gone through the report with a fine-toothed comb, you’re raising a lot of questions—I can do the same thing.”
The interviewer also asks Hamilton whether he has any unanswered questions of his own about 9/11. Hamilton’s response is: “I could never figure out why these 19 fellas did what they did. We looked into their backgrounds. In one or two cases, they were apparently happy, well-adjusted, not particularly religious - in one case quite well-to-do, had a girlfriend. We just couldn’t figure out why he did it. I still don’t know.” [Canadian Broadcasting Corporation, 8/21/2006]

[Source: Public domain]The House Intelligence Committee, led by Peter Hoekstra (R-MI), releases a 29-page report entitled “Recognizing Iran as a Strategic Threat: An Intelligence Challenge for the United States” that blasts the CIA and other US intelligence agencies for lacking “the ability to acquire essential information necessary to make judgments” on Iran’s nuclear program, its intentions, or its ties to terrorism. [House Intelligence Committee, 8/23/2006]
Democrats Excluded From Report - The report is generated strictly by the Republicans on the committee; input from Democratic members was quite limited. The author of the report is ex-CIA officer Frederick Fleitz, a former special assistant to Undersecretary of Defense John Bolton and a hardliner on Iran. Not surprisingly, Fleitz’s report fully supports the Bush administration’s position that Iran is moving aggressively to acquire nuclear weapons, and thusly poses an significant threat to the US. It also claims that the US intelligence community has not tried to collect or collate evidence to prove Fleitz’s assertion that Iran, a majority-Shi’ite nation, has close and sinister ties to al-Qaeda, a Sunni organization, as well as some responsibility for the fighting between Israel and Hezbollah in southern Lebanon. Fleitz and his researchers used nothing more than publicly available documents for his report, and did not interview any intelligence officials. Hoesktra, who publicly releases the report before it is approved by the full committee, says his purpose is to avoid the intelligence “mistakes” that led the US to conclude that Iraq possessed weapons of mass destruction. It is widely believed that Hoekstra’s decision to release the report is part of a larger effort by the Bush administration to pressure Iran to suspend its nuclear program, a push supported by few US allies. Democrats on the committee have little confidence that the report is complete and accurate; ranking subcommittee member Rush Holt (D-NJ) says the report is not “prepared and reviewed in a way that we can rely on.” [Washington Post, 8/24/2006]
Cherrypicking - The report will never be voted on or discussed by the entire committee, in essence short-circuiting Democrats from the review and approval process. Ranking member Jane Harman (D-CA) says the report “took a number of analytical shortcuts that present the Iran threat as more dire—and the Intelligence Community’s assessments as more certain—than they are.” It is not long before the report is thoroughly debunked. Further analysis shows the report to be riddled with errors; additionally, it fails to include key information, mostly from the International Atomic Energy Agency (IAEA) that disproves the report’s claims about Iran’s nuclear program. When the report is officially presented in September 2006, IAEA officials and others will term the report “outrageous and dishonest,” and provide evidence refuting its major claims (see September 14, 2006). Gary Sick, an Iran expert and a former National Security Council under Jimmy Carter, notes that the report’s claim that Iran has “the largest inventory of ballistic missiles in the Middle East” entirely ignores the far larger arsenals possessed by Israel and Saudi Arabia. “If you are going to take on the entire US intelligence community, it is a very good idea to at least get your basic facts straight,” Sick says. “It is a sloppy attempt to lay the ground for another ‘slam-dunk’ judgement and a potential rush to war. It deserves to be recognized for what it is.” David Albright agrees: “This is like prewar Iraq all over again.” Albright, a former UN weapons inspector and president of the Institute for Science and International Security, says, “You have an Iranian nuclear threat that is spun up, using bad information that’s cherry-picked and a report that trashes the [IAEA] inspectors.” Weeks after the November 2006 elections, the CIA will report that it can find no evidence supporting Fleitz’s contention that Iran has a secret nuclear weapons program. An Attempt to Undermine Rice and Diplomatic Outreach? - Many committee Democrats believe that the report is an attempt by hardline Republicans to undermine Secretary of State Condoleezza Rice, who has agreed to talk with the Iranians under certain conditions. Bolton, Fleitz, and others oppose any diplomacy or discussion with Iran. Bolton is now the US ambassador to the UN; he and Fleitz worked diligently during President Bush’s first term to undermine the efforts of Rice’s predecessor, Colin Powell, to engage Iran, North Korea, and Syria in diplomatic talks. Many Washington neoconservatives have denounced the Bush administration’s tentative move towards diplomatic talks with Iran as nothing more than “appeasement.” (Perhaps in the same vein, Fleitz is now working on a similar report on North Korea’s weapons program; a draft leaked to the Washington Post contains allegations about the North Korean program that also cannot be substantiated.) 'Unusually Slick' Hoax - Former CIA official Ray McGovern calls the report an “unusually slick” hoax that is nothing more than an attempt to frighten Congress and the American people into supporting the Bush administration’s more aggressive posture towards Iran. McGovern notes that in recent weeks Hoekstra told a Fox News audience that weapons of mass destruction were indeed found in Iraq—“We were right all the time!”—and observes that the entire report is a calculated public relations effort based on overzealous falsehoods and not on verifiable fact. The cover of the report depicts Iranian president Mahmoud Ahmadinejad giving a suspiciously Nazi-like salute, and the first page repeats Ahmadinejad’s assertion that Israel “must be wiped off the face of the map.” He also notes that Fleitz, whom he describes as Bolton’s “chief enforcer” when Bolton was at the State Department, once told State Department intelligence analysts Christian Westermann that it was “a political judgment as to how to interpret” data on Cuba’s biological weapons program (a program that only existed in Bolton’s imagination) and that the intelligence community “should do as we asked” in making its reports. McGovern concludes, “Hoekstra’s release of this paper is another sign pointing in the direction of a US attack on Iran. Tehran is now being blamed not only for inciting Hezbollah but also for sending improvised explosive devices [IEDs] into Iraq to kill or maim US forces. There is yet another, if more subtle, disquieting note about the paper. It bears the earmarks of a rushed job, with very little editorial scrubbing.… It seems to me possible that the Cheney-Rumsfeld cabal told Hoekstra to get the paper out sooner rather than later, as an aid to Americans in ‘recognizing Iran as a strategic threat.’” [Antiwar.com, 8/26/2007]
Replay of Flawed Iraqi Intelligence - Many observers agree with McGovern that the report is a replay of the dangerously flawed intelligence estimates that pushed Congress to approve military action against Saddam Hussein’s Iraq. Gary Sick goes even further back to draw a comparison between Hoekstra’s report and the mid-1970s effort by Ford aides Dick Cheney and Donald Rumsfeld’s so-called “Team B” to provide an “alternative” intelligence assessment on the threat posed by the then-Soviet Union. The report “is really intended as a sort of Team B report of what at least one [Congressional] staffer believes the intelligence community should be reporting on Iran.” [Inter Press Service, 8/25/2006] Author and national security expert John Prados takes an even grimmer view: “The fact that this act has been perpetrated by a congressional committee whose job it is to oversee US intelligence is further evidence that intelligence oversight has become part of the problem, not the solution.” [Tom Paine (.com), 8/25/2006]

Conservative pundits and columnists launch a new barrage of attacks and accusations against former ambassador Joseph Wilson (see July 6, 2003) and his wife, outed CIA agent Valerie Plame Wilson (see July 14, 2003). The pundits use the recent revelation that former Deputy Secretary of State Richard Armitage was apparently the first administration official to leak Plame Wilson’s name to the press (see August 22, 2006 and September 7, 2006). They claim that the new information proves that there was never a conspiracy to “out” Plame Wilson (see June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, and Before July 14, 2003), but that her status as a covert CIA agent was revealed merely as a result of harmless gossip from Armitage, who is not considered a major part of the neoconservative axis of power within the White House. Blaming Armitage and the State Department - The Wall Street Journal blames Armitage for allowing the Plame Wilson identity leak investigation to go on while he remained mute, allowing “political opportunism and internal score-settling” to drive the investigation when it never should have taken off. “The White House, in short, was not engaged in any campaign to ‘out’ Ms. Plame [Wilson],” the editorial states. Since the prosecution of Lewis Libby for perjury and obstruction during the investigation is not likely to be dropped, the editorial concludes, President Bush should end it by pardoning Libby. [Wall Street Journal, 8/30/2006] The New York Sun also chastizes Armitage for standing silent “while the president’s critics sullied the good names of Messrs. Cheney, Libby, and Rove.” [National Review, 7/19/2004; New York Sun, 8/30/2006] A similar position is advocated by neoconservative John Podhoretz, writing for the New York Post, who also says that the Armitage revelation should result in special counsel Patrick Fitzgerald dropping all charges against Libby. [New York Post, 8/29/2006] Neoconservative Frank Gaffney, writing for the online political publication TownHall, accuses both Armitage and former Secretary of State Colin Powell, as well as other senior State Department officials, of being “disloyalists” who “wage[d] war” against the Bush administration “from behind enemy lines”—from his position in the State Department, essentially functioning as a saboteur for unnamed liberal interests, and to win ground the State Department lost in conflicts with the White House. Gaffney goes further, accusing other State Department officials of intentionally sabotaging US nuclear negotiation efforts with North Korea (see September 19-20, 2005 and July 15, 2006). He accuses Armitage of “destructive and disloyal behavior” and “appeasement” towards North Korea and other US opponents. [Town Hall (.com), 9/5/2006] San Francisco Chronicle writer Debra Saunders calls the entire affair nothing more than “gossip,” and notes that an admission by White House deputy chief of staff Karl Rove that he confirmed Plame Wilson’s identity (see July 10, 2005 and October 14, 2005) is virtually meaningless. The only “abuse of power” that has come to light during the investigation, Saunders opines, is the investigation itself. [Minneapolis Star-Tribune, 9/6/2006]
Libby 'Exonerated' by Armitage Admission - The New Hampshire Union Leader calls the investigation a “non-issue” promulgated by “conspiracy nuts” now proven wrong by the Armitage admission. [New Hampshire Union Leader, 8/30/2006] Syndicated columnist Linda Chavez says the “exculpatory” Armitage revelation exonerates Libby, and calls his prosecution “malicious” and unwarranted. [Creators Syndicate, 8/30/2006]
Wilson, 'Leftists' to Blame - Slate’s Christopher Hitchens goes further, attacking the “Joseph Wilson fantasy” that Iraq had not attempted to buy uranium from Niger (see March 4-5, 2002, (March 6, 2002) and March 8, 2002), calling the idea that the White House deliberately attempted to smear Wilson’s character a “paranoid fantasy” (see June 2003, June 3, 2003, June 11, 2003, June 12, 2003, June 19 or 20, 2003, July 6, 2003, July 6-10, 2003, July 7, 2003 or Shortly After, 8:45 a.m. July 7, 2003, 9:22 a.m. July 7, 2003, July 7-8, 2003, July 11, 2003, (July 11, 2003), July 12, 2003, July 12, 2003, July 18, 2003, October 1, 2003, April 5, 2006, and April 9, 2006), and concluding that the entire Plame Wilson imbroglio was the result of a “venom[ous] interdepartmental rivalry” between Armitage’s State Department and the White House, blown entirely out of proportion by liberal critics of the Bush administration. [Slate, 8/29/2006] A National Review editorial blames the New York Times editorial board and “shrieking” “leftist adversaries” of the Bush administration for the investigation, and, like Chavez and others, calls for the immediate end of the Libby prosecution. [National Review, 8/30/2006] The Weekly Standard’s Fred Barnes compiles a “rogues list” of “the Plamegate Hall of Shame,” including Armitage, his former boss Colin Powell, Patrick Fitzgerald, the Justice Department, Joseph Wilson, and the media. “So instead of Cheney or Rove or Libby,” Barnes writes, “the perennial targets of media wrath, the Plamegate Hall of Shame consists of favorites of the Washington elite and the mainstream press.” And like the others, Barnes calls on Fitzgerald to immediately terminate his investigation as well as his prosecution of Libby. [Weekly Standard, 9/2/2006] And the Washington Times’s editor in chief Wesley Pruden rounds off the attacks, rather ghoulishly predicting that the next time Plame Wilson will be mentioned in the press is when “a nice obituary in the Washington and New York newspapers and a few lines of a telegraph dispatch on a page with the truss ads in Topeka” is printed. He calls Plame Wilson, who headed the CIA’s Joint Task Force on Iraq (see April 2001 and After), “the queen of the clipping scissors and pastepots at the CIA” (see September 29, 2003), and calls the leak investigation a “fraud.” [Washington Times, 9/5/2006]
Picked Up by Mainstream Media - Many in the mainstream media echo the new line of attack, with the Washington Post’s editorial board joining the other editorials and columnists in demanding that the Libby prosecution be immediately terminated. Echoing a Wall Street Journal guest editorial from almost a year before (see November 3, 2005), the Post editorial claims that because Plame Wilson’s husband, former ambassador Joseph Wilson, went public with his knowledge of the Bush administration’s false claims that Iraq had attempted to purchase uranium from Niger (see July 6, 2003), he is ultimately responsible for outing his wife. The Post writes: “Mr. Wilson chose to go public with an explosive charge, claiming—falsely, as it turned out—that he had debunked reports of Iraqi uranium-shopping in Niger and that his report had circulated to senior administration officials. He ought to have expected that both those officials and journalists such as Mr. Novak would ask why a retired ambassador would have been sent on such a mission and that the answer would point to his wife. He diverted responsibility from himself and his false charges by claiming that President Bush’s closest aides had engaged in an illegal conspiracy. It’s unfortunate that so many people took him seriously.” The allegation that Wilson had “falsely… debunked reports of Iraqi uranium-shopping in Niger” is itself false, as Wilson’s report further proved that no such deals ever took place (see March 4-5, 2002, (March 6, 2002) and March 8, 2002). [Washington Post, 9/1/2006] The New York Times’s conservative columnist, David Brooks, joins in the attacks, calling the exposure of Plame Wilson a “piffle” (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, October 29, 2005, and February 13, 2006) blown out of proportion by a group of Congressional Democrats and the 2004 presidential campaign of John Kerry. Like the others, he blames Armitage for “keep[ing] quiet while your comrades are being put through the ringer [sic].” [New York Times, 8/31/2006] Days later, the Post’s David Broder writes that Karl Rove, one of the White House officials who outed Plame (see July 8, 2003 and 11:00 a.m. July 11, 2003), had been treated badly by reporters and pundits, and deserved a round of apologies. [Washington Post, 9/7/2006]
'Marvel of Wingnut Logic' - Author Jane Hamsher, writing for the progressive blog FireDogLake, hammers the Post editorial and its presumed author, op-ed editor Fred Hiatt, writing with some apparent outrage: “[T]o argue that somehow this [Armitage] leak—which played no part in the concerted administration effort to bully, intimidate, and punish Joe Wilson—should somehow excuse Scooter Libby and Karl Rove’s subsequent actions is a true marvel of wingnut logic. Incredibly it is somehow okay to rob the liquor store, shoot the owner, rape the cashier, and spatter the walls with blood because someone else was caught shoplifting there the week before. It is the Sistine Chapel of bad faith editorials.” [Jane Hamsher, 9/1/2006]
Comparisons to Soviet Propaganda - Plame Wilson herself is “furious” at reading the Post editorial and other, similar writings. In her 2007 book Fair Game, she will write, “I suddenly understood what it must have felt like to live in the Soviet Union and have only the state propaganda entity, Pravda, as the source of news about the world.” Plame Wilson calls the allegations that her husband is responsible for outing her “flatly untrue,” and shows the writers’ “ignorance about how our clandestine service functions.” She notes that the FBI had known of the Armitage leak since October 2003, and that since “the FBI didn’t shut down the investigation” this indicated “they had good reason to believe that Libby and Rove were lying to them.” [Wilson, 2007, pp. 257-260]

A legal associate of former Deputy Secretary of State Richard Armitage says that Armitage has admitted to being one of the government officials who told columnist Robert Novak that Valerie Plame Wilson was a CIA official (see July 8, 2003 and July 14, 2003). According to the lawyer, Armitage has confirmed being Novak’s “primary,” or original, source for the information. Armitage’s role as one of the government leakers of Plame Wilson’s identity has recently come to light in the press (see August 22, 2006), though earlier press reports have focused on Armitage’s leak to Washington Post reporter Bob Woodward (see June 13, 2003). [New York Times, 8/29/2006]
According to a later report by the Los Angeles Times, the FBI’s investigation into the 2001 anthrax attacks (see October 5-November 21, 2001) remains “fixated” on suspect Steven Hatfill into late 2006. Senior FBI agent Richard Lambert took over as head of the investigation in late 2002 (see Late 2002), and kept the focus on Hatfill. The change in focus comes just after August 25, 2006, when Lambert is removed as head of the investigation and reassigned to be the head of an FBI field office instead. The Times will later reveal that some FBI agents were frustrated with Lambert’s single-minded focus on Hatfill and sought a review of Lambert by the FBI’s Inspection Division. One agent will later say: “There were complaints about him. Did he take energy away from looking at other people? The answer is yes.” But Lambert was not alone; the Times will also report, “The fixation on Hatfill ran broadly through FBI leadership.” An FBI agent later says: “They exhausted a tremendous amount of time and energy on [Hatfill].… I’m still convinced that whatever seemed interesting or worth pursuing was just basically nullified in the months or year following when ‘person of interest’ came out about Hatfill.” Another investigator will say: “Particular management people felt, ‘He is the right guy. If we only put this amount of energy into him, we’ll get to the end of the rainbow.’ Did it take energy away? It had to have. Because you can’t pull up another hundred agents and say, ‘You go work these leads [that] these guys can’t because they’re just focused on Hatfill.’” [Los Angeles Times, 6/29/2008] In October 2006, NBC News reports: “the FBI recently installed a new team of top investigators to head up the anthrax case. Sources familiar with the case tell NBC News that the new managers are looking anew at all possible suspects, with a much broader focus than before. The sources say that the previous head of the case, inspector Richard Lambert, was moved to a new position within the FBI, in part because he had focused too much on Hatfill.” [MSNBC, 10/24/2006]
Actor Kiefer Sutherland as ‘Jack Bauer.’ [Source: Stuff.co.nz]Law professor Phillippe Sands begins a series of interviews with the former staff judge advocate for the US Army in Guantanamo, Lieutenant Colonel Diane Beaver. She is the author of a legal analysis that was used by the Bush administration to justify its extreme interrogation techniques (see October 11, 2002). Sands describes her as “coiled up—mistreated, hung out to dry.” She is unhappy with the way the administration used her analysis, and notes that she was guided in her work at Guantanamo by personnel from the CIA and Defense Intelligence Agency. She believes that some of the interrogation techniques were “reverse-engineered” from a training program called SERE—Survival, Evasion, Resistance, and Escape—though administration officials have denied this. Several Guantanamo personnel were sent to Fort Bragg, SERE’s home, for a briefing on the program (see December 2001, January 2002 and After, Mid-April 2002, Between Mid-April and Mid-May 2002, July 2002, July 2002, July 2002, and August 1, 2002). Military training was not the only source of inspiration. Fox’s television drama 24 came to a conclusion in the spring of 2002, Beaver recalls. One of the overriding messages of that show is that torture works. “We saw it on cable,” Beaver remembers. “People had already seen the first series. It was hugely popular.” The story’s hero, Jack Bauer, had many friends at Guantanamo, Beaver adds. “He gave people lots of ideas.” She recalls in graphic terms how excited many of the male personnel became when extreme interrogation methods were discussed. “You could almost see their d_cks getting hard as they got new ideas,” she will say. “And I said to myself, You know what? I don’t have a d_ck to get hard—I can stay detached.” The FBI and the Naval Criminal Investigative Service refused to become involved in aggressive interrogations, she says (see Late March through Early June, 2002 and December 17, 2002). Abd al-Hadi al-Iraqi. [Source: FBI]Abd al-Hadi al-Iraqi, said to be an adviser to Osama bin Laden, is captured and detained in a secret CIA prison. President Bush announced on September 6, 2006 that the secret CIA prisons have just been emptied, at least temporarily (see September 2-3, 2006 and September 6, 2006). Nonetheless, Al-Hadi is put in the CIA’s secret prison system (see Autumn 2006-Late April 2007). Very little is known about al-Hadi’s arrest, which will not even be announced until late April 2007, shortly after he is transferred to the Guantanamo prison. It is unknown whether he is captured before Bush’s announcement (in which case he should have been sent to Guantanamo with other high-ranking prisoners), or after. [Salon, 5/22/2007] Prior to Al-Hadi’s arrest, the US government had posted a $1 million reward for his capture. His reward announcement calls him “one of Osama bin Laden’s top global deputies, personally chosen by bin Laden to monitor al-Qaeda operations in Iraq.… He has been associated with numerous attacks in Afghanistan and Pakistan and has been known to facilitate communication between al-Qaeda in Iraq and al-Qaeda.” The announcement notes that al-Hadi once served as a major in the Iraqi army, and he may still be in contact with bin Laden. [Rewards for Justice, 1/4/2007] In 2005, Newsweek reported that al-Hadi had been the main liaison between bin Laden and the independent minded Islamist militant leader Abu Musab al-Zarqawi in Iraq. Karl Eikenberry. [Source: NATO]In autumn 2006, President Bush declares in a White House news conference that al-Qaeda is “on the run,” but in fact intelligence reports are indicating that al-Qaeda is gaining strength in its safe haven in Pakistan’s tribal region. The New York Times will later comment, “with senior Bush administration officials consumed for much of that year with the spiraling violence in Iraq, the al-Qaeda threat in Pakistan was not at the top of the White House agenda.” Frustrated, Lt. Gen. Karl Eikenberry, the top US commander in Afghanistan, orders military officers, CIA, and US special forces to assemble a dossier documenting the Pakistani government’s role in allowing militants to establish their safe haven in the tribal region. According to the Times, “Behind the general’s order was a broader feeling of outrage within the military—at a terrorist war that had been outsourced to an unreliable ally, and at the grim fact that America’s most deadly enemy had become stronger.” When Eikenberry finally presents his dossier to several members of Bush’s cabinet, some inside the State Department and the CIA dismiss his warning as exaggerated and simplistic. [New York Times, 6/30/2008] On February 13, 2007, Eikenberry states publicly before a Congressional committee that NATO cannot win in Afghanistan without addressing the safe haven across the border in Pakistan. He does not publicly discuss Pakistan’s support for the militants, but he does say, “A steady, direct attack against the command and control in Pakistan in sanctuary areas is essential for us to achieve success.” He also warns that the US is facing a “reconstituted enemy” and “growing narcotics trafficking” in Afghanistan, which could lead to “the loss of legitimacy” of the government there. Eikenberry is already due to be replaced as commander of US forces in Afghanistan by the time he makes these blunt comments. [Washington Post, 2/14/2007; Rashid, 2008, pp. 383] The White House responds by sending Vice President Dick Cheney and CIA Deputy Director Stephen Kappes to Islamabad, Pakistan, later in February (see February 26, 2007). But there is little apparent change in Pakistan’s behavior. [New York Times, 6/30/2008]
Michael Tabman, the Minneapolis FBI field office’s special agent in charge, prevents Harry Samit from speaking at a national security forum about the Moussaoui case and removes him from counterterrorism investigations. Samit was an important figure in the Zacarias Moussaoui investigation just before 9/11 (see August 15-September 10, 2001, August 16, 2001 and August 20-September 11, 2001). Unlike his former colleague Coleen Rowley (see May 21, 2002 and February 26, 2003), Samit has never gone public with his criticism of the FBI’s handling of the case. Tabman has been working at the Minneapolis office only since 2005. After Samit files a complaint, FBI headquarters will reassign him to counterterrorism and send Tabman back to headquarters. By autumn 2006, al-Qaeda’s central leadership based in Pakistan’s tribal region near the border of Afghanistan appears to be short on funds. But a peace treaty signed between the Pakistani government and Islamist militants in the tribal region of North Waziristan in early September 2006 (see September 5, 2006) gives al-Qaeda’s leaders breathing room and allows them to receive money from new sources abroad. US intelligence determines that al-Qaeda in Pakistan is increasingly funded by the Iraq war. Operatives in Iraq are raising considerable sums from donations to the anti-US insurgency there, as well as criminal activity such as kidnappings for ransom common in the chaos of the Iraq war zone. Al-Qaeda’s central command had previously sent money outward to Iraq and elsewhere. A senior US counterterrorism official will say in 2007, “Iraq is a big moneymaker for them.” The Pakistani peace deal with militants results in tens of thousands of Pakistani soldiers withdrawing from the tribal regions. This in turn allows militants to move between Pakistan and Iraq much easier than before. This official will say there are “lots of indications they can move people in and out easier,” and that operatives from Iraq often bring money. “A year ago we were saying they were having serious money problems. That seems to have eased up.” It is also believed that Taliban forces in Afghanistan are now being taught by al-Qaeda operatives experienced with fighting US forces in Iraq. In early September 2006, Anwar al-Awlaki is arrested in Yemen at the request of the US government. Al-Awlaki served as imam to several of the 9/11 hijackers when they lived in the US (see March 2001 and After). [Australian, 11/4/2006] However, al-Awlaki is released in December 2007. The US was limited in how much it could pressure the government of Yemen to keep holding him, because he has never been formally charged with any crime. In a taped interview shortly after his release, he claims that while he was imprisoned in Yemen, he was interrogated by the FBI multiple times and asked about his dealings with the 9/11 hijackers. [Washington Post, 2/27/2008] According to the New York Times, “by the end of 2007, American officials, some of whom were disturbed at the imprisonment without charges of a United States citizen, signaled that they no longer insisted on al-Awlaki’s incarceration, and he was released.” [New York Times, 5/8/2010] By February 2008, just two months after US officials approved his release, US intelligence will conclude that al-Awlaki is linked to al-Qaeda (see February 27, 2008).
The New York Post editorial board writes that, in light of recent revelations that former Secretary of State Richard Armitage leaked the name of Valerie Plame Wilson to reporters Bob Woodward and Robert Novak (see August 22, 2006, Late August-Early September, 2006, and Late August-Early September, 2006), the only remaining question is “how to do right by the principal victim of the farce—former vice presidential aide I. Lewis ‘Scooter’ Libby?” The Armitage revelation “completely unravels the notion that there was a broad institutional conspiracy” to expose the CIA identity of Plame Wilson, the Post states, and for three years Libby and the Bush administration have been victimized by “loony-left conspiracy-mongering.” The Post blames Armitage and his then-boss, former Secretary of State Colin Powell, for standing by while the outcry against the Plame Wilson leak developed. Even though “Libby shouldn’t have lied to investigators, as he is alleged to have done,” the Post says “the investigation should never have been launched in the first place. It was the product of wild charges from an embittered, partisan former official [Joseph Wilson—see July 6, 2003], combined with bad faith and lack of candor from the top two men at State.” The Post concludes with a call for President Bush to pardon Libby and “let the country put this sorry episode behind it.” [New York Post, 9/2/2006] A day later, the Boston Herald editorial board issues an almost identical call for a presidential pardon for Libby, and excoriates Armitage and Powell for their roles in the affair. [Boston Herald, 9/3/2006] Two days after the Herald publishes its editorial, the Los Angeles Times publishes an editorial which does not directly advocate a pardon for Libby, but calls the Plame Wilson identity leak investigation and the trial a “dark comedy of errors” that should have been ended “long ago.” [Los Angeles Times, 9/5/2006]

Mohamad Farik Amin. [Source: FBI]The US temporarily closes a network of secret CIA prisons around the world and transfers the most valuable prisoners to the US prison in Guantanamo, Cuba, for eventual military tribunals. The prison network will be reopened a short time later (see Autumn 2006-Late April 2007). There were reportedly fewer than 100 suspects in the CIA prisons; most of them are apparently sent back to their home countries while fourteen are sent to Guantanamo. All fourteen have some connection to al-Qaeda. Seven of them reportedly had some connection to the 9/11 attacks. Here are their names, nationalities, and the allegations against them.
Khalid Shaikh Mohammed (KSM) (Pakistani, raised in Kuwait). He is the suspected mastermind of 9/11 attacks and many other al-Qaeda attacks. A CIA biography of KSM calls him “one of history’s most infamous terrorists.”
Mustafa Ahmed al-Hawsawi (Saudi). He allegedly helped finance the 9/11 attacks.
Hambali (Indonesian). He attended a key planning meeting for the 9/11 attacks in Malaysia (see January 5-8, 2000) and is accused of involvement in many other plots, including the 2002 Bali bombings (see October 12, 2002).
Khallad bin Attash (a.k.a. Tawfiq bin Attash) (Yemeni). He also attended a key planning meeting for the 9/11 attacks in Malaysia (see January 5-8, 2000) and had a role in other plots such as the 2000 USS Cole bombing (see October 12, 2000).
Ali Abdul Aziz Ali (Pakistani, raised in Kuwait). He allegedly helped finance the 9/11 attacks and arranged transportation for some hijackers. His uncle is KSM.
Ramzi bin al-Shibh (Yemeni). A member of the Hamburg al-Qaeda cell with Mohamed Atta and other 9/11 hijackers. The CIA calls him the “primary communications intermediary” between the hijackers and KSM. He also attended a key planning meeting for the 9/11 attacks in Malaysia (see January 5-8, 2000).
Abd al-Rahim al-Nashiri (Saudi). He is said to have been one of the masterminds of the USS Cole bombing (see October 12, 2000). He also attended a key planning meeting for the 9/11 attacks in Malaysia (see January 5-8, 2000).
The remaining seven suspects are alleged to have been involved in other al-Qaeda plots:
Abu Zubaida (Palestinian, raised in Saudi Arabia). He is said to be a facilitator who helped make travel arrangements for al-Qaeda operatives. He is also alleged to have organized a series of planned millennium attacks.
Ahmed Khalfan Ghailani (Tanzanian). He was indicted for a role in the 1998 African embassy bombings (see 10:35-10:39 a.m., August 7, 1998). He is also said to be an expert document forger.
Majid Khan (Pakistani). He lived in the US since 1996 and is said to have worked with KSM on some US bomb plots (see March 5, 2003).
Abu Faraj al-Libbi (a.k.a. Mustafa al-‘Uzayti) (Libyan). He allegedly became al-Qaeda’s top operations officer after KSM was captured.
Mohamad Farik Amin (a.k.a. Zubair) (Malaysian). He is a key Hambali associate and was allegedly tapped for a suicide mission targeting Los Angeles.
Mohammed Nazir Bin Lep (a.k.a. Lillie) (Malaysian). He is a key Hambali associate. He is accused of providing funds for the 2003 bombing of the Marriott hotel in Jakarta, Indonesia (see August 5, 2003). He was allegedly tapped for a suicide mission targeting Los Angeles.
Gouled Hassan Dourad (Somali). He allegedly scouted a US military base in Djibouti for a planned terrorist attack.

Rowan Scarborough. [Source: NNDB (.com)]Washington Times reporter Rowan Scarborough writes an extensive analysis of the Plame Wilson identity leak investigation, calling it an attempt by liberals to bring down a Republican president just as the Nixon-era Watergate scandal did (see October 18, 1972 and June 27, 1973), and accuses “leftists” throughout Congress and the media of orchestrating a smear campaign against former White House official Lewis Libby. Special counsel Patrick Fitzgerald is little more than a tool of those “leftists,” he writes. Scarborough, who is not identified as the author by the Times but is identified on the reprint of the article on the Libby Legal Defense Fund Web site, reviews and echoes many of the same criticisms others on the right have already stated, that since Libby was not the first administration official to leak Valerie Plame Wilson’s identity to a reporter, he must be innocent of the charges against him (see Late August-Early September, 2006). “[T]he ‘scandal’ is played out,” Scarborough writes, and the hopes of liberals to see the destruction of the Bush administration are “shattered.” Scarborough says that Libby (see June 23, 2003, 8:30 a.m. July 8, 2003, 2:24 p.m. July 12, 2003, and Late Afternoon, July 12, 2003) and former Deputy Secretary of State Richard Armitage (see June 13, 2003 and July 8, 2003) revealed Plame Wilson’s identity for no other reason than to set the record straight about Plame Wilson sending her husband, Joseph Wilson, to Niger to investigate claims that Iraq had tried to purchase uranium from that country (see February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005). Armitage and Libby were concerned, Scarborough writes, that Wilson went to Niger at the behest of Vice President Dick Cheney (see (February 13, 2002)), when in actuality, Scarborough states, Wilson went to Niger, and subsequently printed an influential op-ed in the New York Times (see July 6, 2003), “to chastise the president for citing a British intelligence report in his January 2003 State of the Union address about a possible Niger-Iraq connection” (see Mid-January 2003 and 9:01 pm January 28, 2003). Scarborough claims falsely that neither the White House nor CIA Director George Tenet knew of Wilson’s trip to Niger (see March 8, 2002); he cites false information promulgated by Republican members of the Senate Intelligence Committee in that body’s report on prewar intelligence and Iraqi WMD (see July 9, 2004), and contradictory statements by conservative columnist Robert Novak (see July 14, 2003, July 21, 2003, September 29, 2003, October 1, 2003, December 14, 2005, July 12, 2006, and July 12, 2006), who outed Plame Wilson in his column (see July 14, 2003). Jonah Goldberg. [Source: MSNBC / MediaBistro (.com)]Conservative columnist Jonah Goldberg, writing for the National Review, compares former ambassador Joseph Wilson (see February 21, 2002-March 4, 2002 and July 6, 2003) to self-proclaimed child murderer John Mark Karr, who falsely confessed to raping and killing six-year-old JonBenét Ramsey. After writing that “Wilson is no more a would-be pedophile than Karr is a former diplomat,” Goldberg calls both men “attention-seeking liars who deliberately helped launch criminal investigations that should never have gone as far as they did” and the beneficiaries of “media feeding frenzies that wasted everybody’s time.” In some ways, Goldberg writes, Wilson is worse than Karr: at least when Karr lied to the press, he attempted to fix the blame for his supposed actions for himself. Wilson, on the other hand, was “a one-man sprinkler system of false accusations” against Bush administration officials such as the “falsely accused” Lewis Libby. Goldberg repeats false claims by Republican members of the Senate Intelligence Committee that Wilson’s discoveries in Niger actually bolstered administration claims of Iraqi attempts to buy Nigerien uranium (see July 9, 2004), and repeats discredited claims that Wilson’s wife, exposed CIA official Valerie Plame Wilson, sent him to Niger (see February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005). Goldberg calls Wilson “self-lionizing” and “vengeful,” and goes one step further than most of his fellow conservatives (see September 5, 2006), saying, “Indeed, there’s good reason to believe Wilson himself leaked the information that Plame was an undercover agent.” Goldberg advances no information to back this particular claim. Instead of doing its “rightful” job in challenging Wilson’s allegations from the outset, Goldberg writes, the “mob” of “liberal pundits” at the New York Times and other press outlets went “hog wild” in chasing the possibility of wrongdoing performed by Bush officials such as Libby and Karl Rove. David Corn, a Nation editor and co-author of the book Hubris with Newsweek reporter Michael Isikoff, reveals the nature of Valerie Plame Wilson’s status and duties as a CIA agent in his column. Isikoff and Corn have revealed similar information in their book; both accounts are based on interviews with confidential CIA sources. To answer the question of whether columnist Robert Novak broke the law when he “outed” Plame Wilson as a covert CIA official (see July 14, 2003) depends on whether Plame Wilson was, indeed, an undercover agent. Novak has called her “an analyst, not in covert operations” (see October 1, 2003). Conservative columnist Jonah Goldberg has called her a “desk jockey” whose CIA status was common knowledge within Washington (see September 30, 2003). A Republican congressman called her a “glorified secretary” (see September 29, 2003). White House officials have suggested that her employment was no real secret. But according to the research done by Isikoff and Corn, none of that is true. Corn writes: “Valerie Wilson was no analyst or paper-pusher. She was an operations officer working on a top priority of the Bush administration. [Richard] Armitage, [Karl] Rove, and [Lewis] Libby had revealed information about a CIA officer who had searched for proof of the president’s case. In doing so, they harmed her career and put at risk operations she had worked on and foreign agents and sources she had handled” (see July 21, 2003, September 27, 2003, October 22-24, 2003, and October 23-24, 2003)). The book also demonstrates that Plame Wilson did not send her husband, Joseph Wilson, on the now-famous trip to Niger as many Bush administration supporters have claimed (see February 21, 2002-March 4, 2002, February 19, 2002, and July 22, 2003). Isikoff and Corn have verified Plame Wilson’s status as a NOC, or “non-official cover” officer, the highest and most clandestine of the CIA’s field agents (see Fall 1992 - 1996). Her job as a NOC was to recruit agents and informants for the CIA in foreign countries. After her return to Washington, she joined the counterproliferation division’s Iraq desk (see 1997), and eventually headed the operations unit of the CIA’s Joint Task Force on Iraq (JTFI), the agency’s unit in learning about Iraq’s WMD programs (see 2002 and April 2001 and After)—which, Corn writes, was first launched months before the 9/11 attacks. Plame Wilson not only worked on JTFI duties in Washington, but in the Middle East, including a trip to Jordan to determine whether aluminum tubes purchased by Iraq were for conventional missiles or for nuclear centrifuges. When Novak blew her cover, she was preparing to change her clandestine status from NOC to official cover, with plans to eventually return to secret operations. As Corn observes, Novak and the White House officials who leaked the information of her CIA status to him (see September 28, 2003) destroyed her chances of continuing her career, jeopardized the foreign agents and sources she had worked with (see October 3, 2003), and hindered the nation’s ability to determine the truth behind the claims of Iraqi WMD. Former Scripps Howard editor Dan Thomasson, writing for the Cincinnati Post, writes that the Plame Wilson identity leak investigation is the most “bizarre, silly, overblown, and wasteful affair” he has seen in his 43 years of Washington reporting. The exposure of Valerie Plame Wilson broke no laws and did no damage to national security or US intelligence-gathering efforts, Thomasson writes (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, October 29, 2005, and February 13, 2006). Once the FBI learned the source of the Plame Wilson leak, whom Thomasson asserts was no one besides former Deputy Secretary of State Richard Armitage (see October 2, 2003), the investigation should have been terminated, even before the appointment of a special counsel to continue it (see December 30, 2003). Thomasson believes that the CIA pushed for the continuance of the investigation “as a diversion from the mounting furor over its own inadequacies in counterintelligence, ranging from the 9/11 terrorist attacks to its assessment of Iraq’s nuclear and biochemical capabilities.” Thomasson concludes that the investigation, and the upcoming Libby trial, are “far worse in [their] potential results and future implications than the original leak ever was.” [Cincinnati Post, 9/6/2006]
Ali Jan Orakzai. [Source: Farooq Naeem/ Agence France-Presse]On September 5, 2006, the government of Pakistan signs an agreement known as the Waziristan Accord with militants in the tribal area of Pakistan near the border of Afghanistan known as Waziristan (see September 5, 2006). Two days later, Pakistani President Pervez Musharraf and Lt. Gen. Ali Jan Orakzai come to the White House to meet with President Bush about the deal. Orakzai is the military commander of the region encompassing the region. He reportedly hates the US and sympathizes with the Taliban, calling them a “national liberation movement” (see Late 2002-Late 2003). In a presentation to Bush, Orakzai advocates a strategy that would rely even more heavily on cease-fires, and says striking deals with the Taliban inside Afghanistan could allow US forces to withdraw from Afghanistan within seven years. Bush supports the deal, saying in public that same day that it would not create safe havens for the Taliban and could even offer “alternatives to violence and terror.” He does add the cautionary note, “You know we are watching this very carefully, obviously.” [Rashid, 2008, pp. 277; New York Times, 6/30/2008] But three months later, the US State Department will publicly deem the deal a failure for US policy (see November-December 2006). Some US officials will begin to refer to Orakzai as a “snake oil salesman.” [New York Times, 6/30/2008]
Former Deputy Secretary of State Richard Armitage admits telling Washington Post reporter Bob Woodward (see June 13, 2003) and columnist Robert Novak (see July 8, 2003) that Valerie Plame Wilson was a CIA official, and says it was a “terrible” mistake to have done so. “Oh, I feel terrible,” he says. “Every day, I think I let down the president. I let down the secretary of state. I let down my department, my family, and I also let down Mr. and Mrs. Wilson.… I value my ability to keep state secrets. This was bad, and I really felt badly about this.” Asked if he owes the Wilsons an apology, Armitage says, “I think I’ve just done it.” He explains his conversation with Novak: “At the end of a wide-ranging interview he asked me, ‘Why did the CIA send Ambassador Wilson [Joseph Wilson, Plame Wilson’s husband] to Africa?’ I said I didn’t know, but that she worked out at the agency.” Armitage calls it “just an offhand question,” and adds, “I didn’t put any big import on it and I just answered and it was the last question we had.” He claims that the State Department intelligence memo that listed Plame Wilson as a CIA agent was only partially classified, and excuses his revelation by saying, “I had never seen a covered agent’s name in any memo in, I think, 28 years of government,” so he had no idea that Plame Wilson was a covert agent. He believes he referred to her as either “Mrs. Wilson” or “Wilson’s wife,” and adds: “I didn’t know the woman’s name was Plame. I didn’t know she was an operative.” Armitage claims he realized he was Novak’s source several months after Plame Wilson’s outing, and immediately informed the FBI (see October 1, 2003). He says he has not publicly discussed his role in the Plame Wilson affair until now because special prosecutor Patrick Fitzgerald asked him to remain silent: “[T]he special counsel, once he was appointed, asked me not to discuss this and I honored his request.” Fitzgerald has now released him from his pledge. Armitage has testified three times before Fitzgerald’s grand jury, the last time in December 2005, without being subpoenaed. “I was a cooperating witness from the beginning,” he says. Al-Qaeda has released some hijacker martyr videos before, usually around 9/11 anniversaries. One of the new videos is of Wail Alshehri. In it he says: “If struggle and jihad is not mandatory now, then when is it mandatory?… When is it time to help Muslims who are under fire in Chechnya? And what about Kashmir and the Philippines? Blood continues to flow. When will it be?” [CNN, 9/8/2006] The other video is of Hamza Alghamdi. In it he says, “If we are content with being humiliated and inclined to comfort, the tooth of the enemy will stretch from Jerusalem to Mecca, and then everyone will regret on a day when regret is of no use.” The videos were made by As-Sahab, al-Qaeda’s media arm. Footage of 9/11 destruction has been digitally added to the backgrounds of the videos after 9/11. [Associated Press, 9/7/2006] Both videos were probably recorded around March 2001, when most of the 9/11 hijackers recorded martyr videos (see (December 2000-March 2001)). The two videos are released at the same time as previously unknown footage of Osama bin Laden with 9/11 hijacker associate Ramzi bin al-Shibh (see September 7, 2006).
The Senate Intelligence Committee, reporting on the pre-invasion intelligence on Iraq, finds that the US intelligence community had no evidence whatsoever of terrorist training facilities or activities at Iraq’s Salman Pak military base. The report says, “Postwar findings support the April 2002 Defense Intelligence Agency (DIA) assessment that there was no credible reporting on al-Qaeda training at Salman Pak or anywhere else in Iraq. There have been no credible reports since the war that Iraq trained al-Qaeda operatives at Salman Pak to conduct or support transnational terrorist operations.” The report will note testimony from both CIA and DIA officials that found “no indications that training of al-Qaeda linked individuals took place there.” The DIA told the committee in June 2006 that it has “no credible reports that non-Iraqis were trained to conduct or support transnational terrorist operations at Salman Pak after 1991.” [Senate Intelligence Committee, 9/8/2006 ] The base was found to be just what the Iraqis said it was: a training camp for counterterrorism operations, focused on foiling terrorist hijackings of jetliners (see April 6, 2003).

Panel Democrats say that the White House knew the intelligence surrounding its claims of such links was flawed and unreliable.
Tenet Admitted to Giving in to Pressure - They note that in July former CIA Director George Tenet told the panel that the White House pressured him to support its arguments and that he agreed despite the findings of his own analysts. “Tenet admitted to the Intelligence Committee that the policymakers wanted him to ‘say something about not being inconsistent with what the president had said,’” says Intelligence Committee member Carl Levin (D-MI). Such compliance was, in hindsight, “the wrong thing to do,” Tenet added, according to Levin. “Well, it was much more than that,” Levin says. “It was a shocking abdication of a CIA director’s duty not to act as a shill for any administration or its policy.” Tenet also admitted that he erred in issuing a statement after President Bush’s October 7, 2002 speech saying that Bush’s claims were consistent with CIA findings (see October 7, 2002).
Republicans Say Report Just 'Election-Year Politicking' - Republican committee members insist that there is little new information about prewar intelligence or claims about Iraq’s links to terrorism. Ranking committee member Pat Roberts (R-KS) accuses Levin and other Democrats of trying to “use the committee… insisting that they were deliberately duped into supporting the overthrow of Saddam Hussein’s regime.… That is simply not true, and I believe the American people are smart enough to recognize election-year politicking when they see it.” Democrats retort that the report speaks for itself.
Impeachment Not Warranted - However, committee Democrats such as John Rockefeller (D-WV) say that the report does not prove any criminal behavior from Bush or his top officials, and say that impeachment of Bush or anyone else is not warranted.
Hussein Opposed to US Policies - An FBI summary quoted in the report shows Hussein acknowledging that his government had met with al-Qaeda leader Osama bin Laden, but denying any collusion. Hussein said he opposed only US policies, and added that “if he wanted to cooperate with the enemies of the US, he would have allied with North Korea or China,” according to the FBI summary.
Other Portions of Report - Other sections of the report find that no evidence existed to support claims that Iraq was reconstituting its nuclear program (see February 7, 2001, February 12, 2001, November 14, 2001, May 2002-September 2002, September 9, 2002, January 9, 2003, March 8, 2003, May 25, 2003, and May 30, 2003), had possessed biological weapons in 2003 (see 2002, 2002-March 2003, Mid-January 2002, March 22, 2002, August 2002, September 2002, September 24, 2002, December 2002, End of December 2002, January 9, 2003, and March 7, 2003), used the Salman Pak facility to train Islamist terrorists (see September 8, 2006), or that Iraqi officials met with 9/11 hijacker Mohamed Atta in the months before the 9/11 attacks (see September 8-10, 2006). The report also finds that the White House relied heavily on false intelligence from Ahmed Chalabi and the Iraqi National Congress (see After August 2, 1989, (1994), January 1996, November 6-8, 2001, Between February 12, 2002 and March 31, 2002, Between February 12, 2002 and March 31, 2002, Summer 2002, and June 26, 2002). A bipartisan Senate report concludes that “Post-war findings… confirm that no such meeting ever occurred” between Mohamed Atta and an Iraqi agent in Prague. It notes that “Post-war debriefings of [the alleged Iraqi agent, Ahmed Khalil Ibrahim Samir al-Ani,] indicate that he had never seen or heard of Atta until after September 11, 2001, when Atta’s face appeared on the news.” [US Senate and Intelligence Committee, 9/8/2006 ] But two days later Vice President Cheney is asked if the meeting ever took place and he still maintains that it could have (see September 10, 2006).
A CIA source tells Harper’s journalist Ken Silverstein that Blackwater owner Erik Prince makes regular visits to CIA headquarters. According to Silverstein, Prince is “very tight” with top agency officials and has a green badge, a security pass for contractors who have access to CIA installations. “He’s over there [at CIA headquarters] regularly, probably once a month or so,” says the source. “He meets with senior people, especially in the [National Clandestine Service, formerly the directorate of operations].” [Harper's, 9/12/2006]
According to Harper’s magazine columnist Ken Silverstein, the private miltiary corporation Blackwater makes an “aggressive” attempt to recruit Jose Rodriguez, director of the CIA’s National Clandestine Service. Other CIA officers currently at Blackwater at this time include Enrique “Ric” Prado, with whom Rodriguez served in Latin America and who is currently Blackwater’s vice president of special programs, and Cofer Black, the company’s vice chairman, who, like Rodriguez, had been chief of the CIA’s Counterterrorist Center. It is reported that the US has not conducted a National Intelligence Estimate (NIE) about al-Qaeda and other Islamist groups since 9/11. An NIE is a formal, top-secret analysis about a particular threat combining intelligence from all relevant government agencies. Michael Scheuer, former head of the CIA’s bin Laden unit, says, “When I left the CIA in November 2004, they had not done an NIE on al-Qaeda. In fact, there has never been an NIE on the subject since the 1990s.” The last NIE on the subject in fact was released in 1997 (see 1997 and Late 2000-September 10, 2001). Rolling Stone magazine concludes, “Today, the [NIE] process remains bogged down in interagency disputes—largely because of resistance by the Pentagon to any conclusions that would weaken its primary role in counterterrorism. As a result, the Bush administration remains uncertain about the true nature of the terrorist foes that America faces—and unable to devise an effective strategy to combat those foes.” [Rolling Stone, 9/12/2006]
Venezuelan President Hugo Chavez suggests that the World Trade Center could have been brought down on 9/11 with explosives. “The hypothesis is not absurd… that those towers could have been dynamited. A building never collapses like that, unless it’s with an implosion. The hypothesis that is gaining strength… is that it was the same US imperial power that planned and carried out this terrible terrorist attack or act against its own people and against citizens of all over the world. Why? To justify the aggressions that immediately were unleashed on Afghanistan, on Iraq. A plane supposedly crashed into the Pentagon, but no one ever found a single remnant of that plane.” Venezuelan Foreign Minister Nicolas Maduro raises the same theories in a speech and calls for an independent investigation. He says: “It’s really worrisome to think that all of that could have been a great conspiracy against humanity. An independent international investigation must be carried out one day to discover the truth about the events of Sept. 11.” [Associated Press, 9/12/2006]
Pakistani journalist Amir Mir tells CNN: “Pakistan is essentially for the Taliban. Almost their entire leadership of Taliban is hiding in Quetta.” Quetta is a Pakistani town close to the Afghan border. CNN further reports that “American intelligence officials say, the Taliban leader Mullah Omar is also living in Quetta.” Senior British government officials say they are angry Pakistan has not rounded up the Taliban leadership “who they say are planning and plotting and getting stronger from the safety of Pakistan.” [CNN, 9/12/2006] The Christian Science Monitor came to a similar conclusion in May 2006 (see May 2, 2006). Several months later, a captured Taliban spokesman will say that Omar is living in Quetta under the protection of the Pakistani ISI (see January 17, 2007).
President Bush tells a journalist that getting Osama bin Laden is a low priority compared to getting intelligence to stop new attacks. Fred Barnes, executive director of the Weekly Standard, and some other journalists met with Bush on September 12, 2006. Asked the next day on Fox News if Bush thinks catching bin Laden is “priority number one,” Barnes replies, “Well, he said, look, you can send 100,000 special forces, that’s the figure he used, to the mountains of Pakistan and Afghanistan and hunt him down, but he just said that’s not a top priority use of American resources. His vision of a war on terror is one that involves intelligence to find out from people, to get tips, to follow them up and break up plots to kill Americans before they occur. That’s what happened recently in that case of the planes that were to be blown up by terrorists, we think coming from England, and that’s the top priority. He says, you know, getting Osama bin Laden is a low priority compared to that.” [Fox News, 9/13/2006]
Mohamed ElBaradei. [Source: MSNBC]The International Atomic Energy Agency (IAEA) responds to a recently released report by Republicans on the House Intelligence Committee on Iran’s nuclear program (see August 23, 2006). The IAEA terms the report “outrageous and dishonest,” and says that the report contains “erroneous, misleading and unsubstantiated statements,” according to a letter from IAEA officials to Peter Hoekstra (R-MI), the chairman of the committee who released the report before it could be voted on by the full committee. Among the numerous errors is the report’s assertion that Iran is producing weapons-grade uranium at its Natanz nuclear facility. Weapons-grade uranium must be enriched to 90% or more to be effective; the Natanz facility is producing uranium enriched to only 3.5%. Intelligence officials point to at least a dozen claims in the report that are either flatly wrong or impossible to substantiate; one such error is the report’s claim that IAEA head Mohamed ElBaradei removed a senior weapons inspector because of that inspector’s concerns over Iranian deception. In fact, that inspector is still working on the inspection process. The report also accuses ElBaradei of having an “unstated” policy preventing inspectors from telling the truth about Iran’s program; this allegation will provoke particular outrage from IAEA officials. The American Enterprise Institute (AEI) holds a press briefing offering its analysis of the 9/11 attacks. Speaking at the event are former UN ambassador Jeane Kirkpatrick, former House Speaker Newt Gingrich, AEI fellow David Wurmser, AEI fellow Michael Ledeen, and one-time Harvard assistant professor Laurie Mylroie. Speaking first is Mylroie, who argues that al-Qaeda could not have pulled the attacks off without the help of Saddam Hussein. “There has been no clear demonstration that Osama bin Laden was involved in Tuesday’s assault on the United States, but there’s been a lot of speculation to that effect, and it may turn out that he is. So assume that he is because I think the key question will be, how likely is it that Osama bin Laden’s group or any other group carried out these attacks alone, unassisted by a state? I’d like to suggest that it is extremely unlikely—in fact, next to impossible.” [Isikoff and Corn, 2006, pp. 67]
At a press conference, President Bush discusses information gained from the interrogation of 9/11 mastermind reveals Khalid Shaikh Mohammed (KSM). In an apparent reference to the 9/11 attacks, Bush says that KSM “described the design of plane attacks on buildings inside the US and how operatives were directed to carry them out.… He told us the operatives had been instructed to ensure that the explosives went off at a point that was high enough to prevent people trapped above from escaping.” [New York Times, 9/15/2006] It is not clear if Bush really meant to say explosives or if this was a verbal slip-up.
Two simultaneous suicide attacks on oil and gas installations in Yemen fail. The Safer refinery in Marib and the al-Dhabba terminal in Hadramout are attacked by four suicide bombers with car bombs, but Yemeni security forces blow the cars up just before they reach their targets. The four suicide bombers and one security guard are killed. The attacks come just a few days after al-Qaeda number two leader Ayman al-Zawahiri called for attacks on oil facilities in the Persian Gulf region. A Yemeni court later sentences 32 men to between two and 15 years in jail for their roles in the attacks. Three of them are alleged al-Qaeda operatives tried in absentia who escaped from prison earlier in 2006 (see February 3, 2006). [BBC, 11/7/2007] Anwar al-Awlaki, an imam for several of the 9/11 hijackers while they lived in the US, was arrested in Yemen earlier in the month (see Early September 2006-December 2007). He allegedly also has a role preparing for the foiled attacks. [Australian, 11/3/2006; Australian, 11/4/2006] The attempted attacks also come just days before Yemen’s presidential elections. Yemeni President Ali Abdallah Saleh, in power since 1978, quickly uses the attacks to criticize his opponent, because one of the opponents’ guards was accused of being involved. The guard is later acquitted. Saleh wins reelection. [New York Times, 3/1/2008] In 2008, one anonymous senior Yemeni official will tell the Washington Post that some important al-Qaeda members have had a long relationship with Yemen’s intelligence agencies and have targeted political opponents in the past. [Source: Public domain]A man on trial in Britain for participation in a fertilizer bomb plot halts his testimony, claiming that Pakistan’s ISI intelligence agency has threatened his family in Pakistan if he continues to talk. Omar Khyam, a Pakistani-Briton, is accused of leading an al-Qaeda linked plot to blow up an unknown target in Britain (see Early 2003-April 6, 2004). Six others are on trial. In testimony on previous days, Khyam confessed to attending a militant training camp in 2000 in the mountains above Rawalpindi, Pakistan. He says that the camp was run by the ISI, and he trained with AK-47 rifles, machine guns, and rocket-propelled grenades. But on the third day of testimony, when asked if he had bought the fertilizer to make a bomb in Britain, he responds: “Before we go on to that topic, I just want to say the ISI in Pakistan has had words with my family relating to what I have been saying about them. I think they are worried I might reveal more about them, so right now, as much as I want to clarify matters, the priority for me has to be the safety of my family so I am going to stop.” He adds, “I am not going to discuss anything related to the ISI any more or my evidence.” [Guardian, 9/19/2006; BBC, 4/30/2007] The ISI has a reputation of arresting family members and threatening them to accomplish their goals. For instance, when Saeed Sheikh was wanted for the murder of reporter Daniel Pearl, the ISI reportedly rounded up 10 members of his family and threatened to harm them, forcing him to turn himself in to the ISI. He later refused to discuss his connection to the ISI, only saying: “I will not discuss this subject. I do not want my family to be killed” (see February 5, 2002). [Vanity Fair, 8/2002] Khyam will be found guilty and sentenced to life in prison (see Early 2003-April 6, 2004).
The Defense Department’s office of the inspector general issues a report saying allegations made by members of the Able Danger program are unfounded. According to the inspector general, Able Danger did not identify any of the 9/11 hijackers before the attacks, the program’s members were not prevented from sharing this information with the FBI, and there was no retaliation against one person involved in the program, Lieutenant Colonel Anthony Schaffer, after he highlighted the issue in the media. The basis for the main claim that the hijackers were not identified before 9/11 is that the recollections of the people who claim lead hijacker Mohamed Atta was identified “varied significantly.” In addition, the names of Atta and the other 9/11 hijackers said to have been identified by the program were not present in any surviving documentation, although the vast majority of the data gathered by the Able Danger program was destroyed several years ago (see May-June 2000). Concerning the blocking of passage of information to the FBI, the inspector general identified only one occasion when this may have happened, but found that such blocking “would not have been inappropriate under the circumstances.” [Department of Defense Office of the Inspector General, 9/18/2006 ]
President Bush signs the 2007 Defense Authorization Act into law. The bill contains a provision that allows the president to more easily declare “martial law” in the US. If Bush or a successor does so, the bill gives the administration the ability to strip much of state governors’ powers over their National Guards and relegate that authority to the federal government. Congress is likely to challenge that provision in the future. The bill makes significant changes to the Insurrection Act that allows the president to invoke the Act during events such as natural disasters, and thereby suspend the 1878 Posse Comitatus Act that prevents the US military from acting in a law enforcement capacity. Senator Patrick Leahy (D-VT) says, “[W]e certainly do not need to make it easier for Presidents to declare martial law. Invoking the Insurrection Act and using the military for law enforcement activities goes against some of the central tenets of our democracy.” [US Senate, 9/19/2006] The relevant section of the bill is entitled “Use of the Armed Forces in Major Public Emergencies.” This section states that “the President may employ the armed forces, including the National Guard in Federal service, to restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of… maintaining public order, in order to suppress, in any State, any insurrection, domestic violence, unlawful combination, or conspiracy.” [US Congress, 9/19/2006] GlobalResearch’s Frank Morales will write that the new law allows the federal government to, if it chooses, “commandeer guardsmen from any state, over the objections of local governmental, military, and local police entities; ship them off to another state; conscript them in a law enforcement mode; and set them loose against ‘disorderly’ citizenry….” Under the new law, the federal government may more easily order National Guard troops to round up and detain protesters, illegal aliens, “potential terrorists,” and just about anyone else, and ship them off to detention facilities. Those facilities were contracted out for construction to KBR, a subsidiary of Halliburton, in January 2006, according to the Journal of Counterterrorism and Homeland Security International, at a cost of $385 million over five years. The Journal noted that “the contract is to be executed by the US Army Corps of Engineers… for establishing temporary detention and processing capabilities to augment existing [immigration] Detention and Removal Operations (DRO)—in the event of an emergency influx of immigrants into the US, or to support the rapid development of new programs.” [GlobalResearch (.ca), 10/29/2006] Virtually no Congressional lawmakers seriously objected to the bill’s provision during debate. One of the few exceptions is Leahy, who will, six weeks later, sharply criticize the provision during debate over a separate piece of legislation. Leahy will say, “Using the military for law enforcement goes against one of the founding tenets of our democracy, and it is for that reason that the Insurrection Act has only been invoked on three—three—[occasions] in recent history. The implications of changing the Act are enormous, but this change was just slipped in the defense bill as a rider with little study. Other congressional committees with jurisdiction over these matters had no chance to comment, let alone hold hearings on, these proposals.… This is a terrible blow against rational defense policy-making and against the fabric of our democracy. Since hearing word a couple of weeks ago that this outcome was likely, I have wondered how Congress could have gotten to this point.… [I]t seems the changes to the Insurrection Act have survived… because the Pentagon and the White House want it.… Because of this rubberstamp Congress,… [w]e fail the National Guard, which expects great things from us as much as we expect great things from them. And we fail our Constitution, neglecting the rights of the States, when we make it easier for the president to declare martial law and trample on local and state sovereignty.” [US Senate, 10/29/2006]

NATO Commander Gen. James L. Jones, Supreme Allied Commander in Europe, says that the Taliban and al-Qaeda continue to profit from the sale of opium in Afghanistan. He says: “We’re losing ground. It affects the insurgency because there’s increasing evidence that a lot of funding goes from the narcotics traffickers to the criminal elements, to what’s left of al-Qaeda, to the Taliban and anyone else that wants to create mischief.” [ABC News, 9/21/2006]
In a Senate Foreign Relations Committee hearing, NATO supreme commander General James L. Jones testifies that the Taliban headquarters is in Quetta, Pakistan. The Taliban presence there has been widely known in intelligence circles since at least 2003 (see April 22, 2003), but this marks the first time a major US figure publicly acknowledges the fact. However, the US still is not pressuring Pakistan very much over the issue. For instance, President Bush did not even bring up the issue when he hosted a dinner recently for Afghan President Hamid Karzai and Pakistani President Pervez Musharraf. Former Nixon White House counsel John Dean is troubled by the Military Commissions Act (MCA) (see October 17, 2006) currently under consideration in Congress. The MCA authorizes military tribunals instead of criminal court trials for suspected terrorists. Dean supported the idea of tribunals when they were first suggested in 2001, but, he writes: “[T]he devil… arrived later with the details. It never occurred to me (and most people) that Bush & Co. would design a system more befitting a totalitarian state than a democratic nation that once led the world by its good example.” After a previous tribunal procedure was struck down by the Supreme Court (see June 30, 2006), Bush sent another proposal to Congress in early September. Where the bill did not actively rewrite the Court’s findings, it ignored them altogether, Dean writes. Dean finds the law a stunning reversal of decades—centuries, in some instances—of US jurisprudence and international law, including its dismissal of Geneva protections, its retroactive protection for US officials who may have tortured detainees, and its dismissal of habeas corpus rights for detainees. Dean calls the proposed legislation “shameful,” and writes: “This proposal… is going to tell us a great deal about where we are as a nation, for as General [Colin] Powell said, ‘The world is beginning to doubt the moral basis of our fight against terrorism. To redefine [the Geneva Conventions] would add to those doubts.’ As will amending the war crimes law to absolve prior wrongs, denying detainees ‘a regularly constituted court affording all the judicial guarantees which are recognized as indispensable by civilized peoples,’ and enacting a law that insults the Supreme Court.” [FindLaw, 9/22/2006]
Osama bin Laden is again rumored to be dead. The rumor is first sparked by the French newspaper L’Est Republicain, which publishes what it describes as a confidential document from the French intelligence service Direction Générale de la Sécurité Extérieure saying that bin Laden died of typhoid on August 23. The report is apparently based on information from Saudi Arabian intelligence. The issue becomes, as Time magazine puts it, “the question of the day,” but the accuracy of the report is questioned by French President Jacques Chirac, Saudi Ambassador to the US Prince Turki al-Faisal, CIA Director Michael Hayden, and others, who all tell the media they think bin Laden may still be alive. Russian President Vladimir Putin, however, remarks that leaks can be used for manipulation, saying, “When there are leaks… one can say that [they] were done especially.” [Time, 9/23/2006; MSNBC, 9/24/2006] Another video of bin Laden footage will be released a week later (see September 30, 2006), apparently by the US. A rumor of bin Laden’s death also preceded an audiotape released earlier in the year (see January 16, 2006, January 19, 2006, and January 19, 2006).

He speculates that Omar Saeed Sheikh, who was involved in the kidnapping and murder of Daniel Pearl (see January 23, 2002) and is said to have wired money to the 9/11 hijackers (see Early August 2001), may have been recruited by MI6 in the 1990s (see Before April 1993). The Independent will also comment, “he does not mention that British-born Omar Saeed Sheikh, who planned the Pearl abduction, had surrendered a week before his arrest was announced to a general with intelligence links who was Musharraf’s friend. What happened during that week?” [Independent, 11/21/2006]
Musharraf writes, “Those who habitually accuse us of not doing enough in the war on terror should simply ask the CIA how much prize money it has paid to the Government of Pakistan.” [Press Trust of India, 9/28/2006] However, US law forbids rewards being paid to a government. The US Justice Department says: “We didn’t know about this. It should not happen. These bounty payments are for private individuals who help to trace terrorists on the FBI’s most-wanted list, not foreign governments.” [London Times, 9/26/2006] Musharraf then backtracks and claims the Government of Pakistan has not received any money from the US for capturing people. [Press Trust of India, 9/28/2006]
He also claims that State Department Official Richard Armitage threatened that if Pakistan did not co-operate with the “war on terror,” the US would bomb it “back into the stone age” (see September 13-15, 2001).
The book does not receive good reviews. For example, the Independent calls it “self-serving and self-indulgent” and concludes that “Readers who want to understand contemporary Pakistan deserve a more honest book.” [Independent, 11/21/2006] In a review with the sub-heading “Most of Gen. Pervez Musharraf’s new book cannot be believed,” the Wall Street Journal writes, “The book is not so much an autobiography as a highly selective auto-hagiography, by turns self-congratulatory, narcissistic, and mendacious.” [Wall Street Journal, 10/19/2006]
The 9/11 Commission interviewed presidents Bill Clinton and George W. Bush in 2004 (see April 29, 2004) but the details of what was revealed in these interviews were not included in the commission’s final report (with one exception, see August 6, 2001). On this day, former 9/11 Commission Richard Ben-Veniste says, “I had hoped that we had—we would have made both the Clinton interview and the Bush interview a part of our report, but that was not to be. I was outvoted on that question.… I didn’t have the votes.… I think the question was that there was a degree of confidentiality associated with that and that we would take from that the output that is reflected in the report, but go no further. And that until some five years’ time after our work, we would keep that confidential. I thought we would be better to make all of the information that we had available to the public and make our report as transparent as possible so that the American public could have that.” [CNN, 9/25/2006]

Omar al-Faruq is killed in a pre-dawn raid by British soldiers in the city of Basra. About 250 soldiers wearing night vision goggles attempted to take al-Faruq alive, but he is killed in a shoot-out. Al-Faruq was born to Iraqi parents and grew up in neighboring Kuwait. Counterterrorism expert Rita Katz comments: “It’s surprising for someone like him to be able to make it to Iraq, where everyone knows how he looks. The guy has long al-Qaeda records.” Experts are especially surprised to find he was in Basra, a heavily Shiite area not friendly to Sunni militants like al-Faruq. A neighbor says that al-Faruq arrived about a month earlier and had relatives in a nearby Sunni enclave. Al-Faruq escaped from the US-run Bagram prison in Afghanistan in July 2005 (see July 11, 2005). [New York Times, 9/26/2006]
Judge Reggie Walton holds a hearing with prosecutors for special counsel Patrick Fitzgerald and representatives from Lewis Libby’s defense team on the issue of “graymail,” which Fitzgerald has alleged is a tactic being employed by Libby’s team (see After October 28, 2005, January 31, 2006, February 6, 2006, and (February 16, 2006)). “Graymail” is the attempt by one side in a court proceeding to derail the proceeding by insisting on the use of classified materials as evidence, and demanding mistrials or dropped charges if and when those classified materials are disallowed. Libby’s lawyers have privately and publicly implied that they will reveal national security secrets if the case actually goes to trial. The hearing, which is delayed because of a bomb threat, is the first of several hearings to be held on the subject. Fitzgerald wants to curtail the introduction of classified documents during the trial, while Libby’s lawyers want to introduce reams of classified documents into evidence (see May 10, 2006). Fitzgerald has argued repeatedly that many of the classified documents requested by Libby are irrelevant to the case at hand. Libby wants to introduce a number of highly classified presidential briefings to show his heavy and varied workload, as support for his defense that he was too overworked to testify accurately before the FBI (see October 14, 2003 and November 26, 2003) and Fitzgerald’s grand jury (see March 5, 2004 and March 24, 2004). Walton has already reminded Fitzgerald that he can dismiss the charges against Libby if he feels the upcoming trial will expose national security secrets. The Military Commissions Act (MCA) (see October 17, 2006) is characterized by many as not applying to US citizens. Law professor Marty Lederman disagrees. Under the MCA, Lederman says, “if the Pentagon says you’re an unlawful enemy combatant—using whatever criteria they wish—then as far as Congress, and US law, is concerned, you are one, whether or not you have had any connection to ‘hostilities’ at all.” [Unclaimed Territory, 9/28/2006] Six months later, an administration lawyer will confirm that the law does indeed apply to US citizens (see February 1, 2007).

Glenn Greenwald. [Source: Mother Jones]Former civil litigator Glenn Greenwald writes that the upcoming passage of the Military Commissions Act (MCA) (see October 17, 2006) is nothing less than “legalizing tyranny in the United States. Period.” Greenwald puts the responsibility on both “the authoritarian Bush administration and its sickeningly submissive loyalists in Congress.” Greenwald continues: “There is a profound and fundamental difference between an Executive engaging in shadowy acts of lawlessness and abuses of power on the one hand, and, on the other, having the American people, through their Congress, endorse, embrace and legalize that behavior out in the open, with barely a peep of real protest. Our laws reflect our values and beliefs. And our laws are about to explicitly codify one of the most dangerous and defining powers of tyranny—one of the very powers this country was founded in order to prevent.” [Unclaimed Territory, 9/28/2006]
The BBC reports on a leaked report about Pakistan from a senior officer at the Defence Academy, a think tank run by the British Ministry of Defence. The author remains anonymous, but he is said to be a man with a military background linked to the MI6, Britain’s external intelligence service. The Ministry of Defence and British government in general say it does not represent their official views. The paper has the following conclusions about Pakistan and the war on terrorism:
Pakistan is not stable, and in fact is on the edge of chaos.
The Pakistani government, through its ISI intelligence agency, has been indirectly supporting terrorism in Afghanistan, Iraq, and attacks overseas, such as the 7/7 London bombings.
Western governments have been turning a blind eye towards Pakistan’s instability and indirect protection of al-Qaeda.
The US and Britain cannot hope to win against Islamist militant group until they identify the real enemies and seek to implement a more just vision. This will require Pakistan to move away from military rule and for the ISI to be dismantled and replaced.
Time is running out for Pakistani President Pervez Musharraf. The US is likely to withdraw his funding and possibly even his protection. Without US support, he is unlikely to stay in power for long.
The wars in Afghanistan and Iraq have not gone well. The war in Iraq in particular has been a great recruitment tool for extremists across the Muslim world.
A secret deal to extricate British troops from Iraq so they could focus on Afghanistan failed when British military leaders were overruled by their civilian leaders.
The enemy the West has identified—terrorism—is the wrong target. As an idea, it cannot be defeated. [BBC Newsnight, 9/28/2006; BBC, 9/28/2006]
The West’s fight against extremism is going nowhere with no end in sight.
Britain should use its military links with Pakistan’s army at a senior level to persuade Musharraf to step down, accept free elections, and dismantle the ISI.
The report’s author traveled to Pakistan in June 2006 as part of a delegation on a fact-finding visit. He held interviews with the Pakistani officials and academics to prepare a report about the country and the global war on terror. [London Times, 9/28/2006] Musharraf rejects the report’s conclusions. He tells the BBC, “There is perfect co-ordination going on” between Pakistan and Western countries on terrorism, and there is “intelligence and operational co-ordination at the strategic level, at the tactical level.” He rejects the idea that the ISI should be dismantled. “I totally, 200% reject it. I reject it from anybody - [Ministry of Defence] or anyone who tells me to dismantle ISI.” [BBC, 9/28/2006]
Senator Barack Obama (D-IL) speaks out against the Military Commissions Act (MCA), which gives the federal government wide latitude to incarcerate and interrogate “terror suspects” without charge or due process of the law (see October 17, 2006). Obama says that “political considerations” for the upcoming midterm elections played a significant role in the timing of the bill, but “what we’re doing here today—a debate over the fundamental human rights of the accused—should be bigger than politics. This is serious. If this was a debate with obvious ideological differences—heartfelt convictions that couldn’t be settled by compromise—I would understand. But it’s not.” Obama notes that in five years of the Bush administration’s system of military tribunals, “not one terrorist has been tried. Not one has been convicted. And in the end, the Supreme Court of the United States found the whole thing unconstitutional (see June 30, 2006), which is why we’re here today. We could have fixed all of this in a way that allows us to detain and interrogate and try suspected terrorists while still protecting the accidentally accused from spending their lives locked away in Guantanamo Bay. Easily. This was not an either-or question.” Congress could have written and passed legislation that would have established “a real military system of justice that would sort out the suspected terrorists from the accidentally accused,” one that would be in line with domestic law and the Geneva Conventions. Instead, “politics won today.… The administration got its vote, and now it will have its victory lap, and now they will be able to go out on the campaign trail and tell the American people that they were the ones who were tough on the terrorists.” Meanwhile, Obama says, questions about the efficacy and legality of the Bush system of justice persist, al-Qaeda and the Taliban are regrouping “while we look the other way,” and the administration is bent on fighting a war in Iraq “that our own government’s intelligence says is serving as al-Qaeda’s best recruitment tool.… This is not how a serious administration would approach the problem of terrorism.” [US Senate, 9/28/2006]

[Source: US Department of Defense]Politically motivated officials at the Pentagon push for convictions of high-profile detainees ahead of the 2008 elections, according to Air Force Colonel Morris Davis, lead prosecutor for terrorism trials at Guantanamo Bay. Davis, whose later resignation is partially caused by this pressure (see July 2007), says the strategic political value of such trials is discussed at a meeting on this day, and that officials prefer “sexy” cases, rather than those that are most solid or ready to go. Davis will later say: “There was a big concern that the election of 2008 is coming up.… People wanted to get the cases going. There was a rush to get high-interest cases into court at the expense of openness.” [Washington Post, 10/20/2007] Davis specifically alleges that Deputy Defense Secretary Gordon England says to him and other lawyers, “We need to think about charging some of the high-value detainees because there could be strategic political value to charging some of these detainees before the election.” [Miami Herald, 3/28/2008]

While the book focuses mainly on politics regarding the Iraq war, it also describes an urgent warning that then-CIA Director George Tenet gave to Condoleezza Rice, National Security Adviser at the time, and other White House officials on July 10, 2001 (see July 10, 2001). [New York Times, 9/29/2006; New York Daily News, 9/29/2006; Washington Post, 10/1/2006] This warning had been mentioned in passing in a 2002 Time magazine article, but it had escaped widespread attention until Woodward’s book. [Time, 8/4/2002] The meeting is particularly controversial because neither the 9/11 Congressional Inquiry nor the 9/11 Commission mentioned in it in their final reports. The 9/11 Commission had learned about it from Tenet in early 2004 (see January 28, 2004). Rice and a number of 9/11 Commissioners deny knowing about the July meeting for several days, until documentation surfaces in the media detailing the meeting and Tenet’s testimony to the commission (see October 1-2, 2006 and September 30-October 3, 2006). Details about the July meeting and surrounding controversies are reported on by the mainstream media for about a week, but there are no articles on it in any prominent newspaper after October 3, 2006. On October 5, Sen. John Kerry (D-MA) formally asks Sen. Richard Lugar (R-IN), chairman of the Senate Foreign Relations Committee, for hearings about the revelations in Woodward’s book, including controversies surrounding the July meeting. Kerry says in a letter to Lugar, “It is necessary to understand the mistakes of the past in order to ensure they are not repeated, and having testimony from the parties under oath will help to sharpen recollections and clarify the exact nature of this important meeting.” However, no hearings take place. [Kerry, 10/5/2006]

[Source: London Times / Sony Pictures]A new videotape showing bin Laden, Mohamed Atta, and Ziad Jarrah in Afghanistan before 9/11 is leaked to the media. NBC reports that the US military obtained the tape at an al-Qaeda compound in Afghanistan in late 2001. NBC filed a freedom of information act request for the video earlier in 2006, but still had not gotten copies when the London Times somehow got a copy and released it. [MSNBC, 9/30/2006] The Times will only say the video was passed to them “through a previously tested channel. On condition of anonymity, sources from both al-Qaeda and the United States have confirmed its authenticity.” There is no sound, and the Times claims that “lip-readers have failed to decipher it, according to a US source.” One part of the tape shows bin Laden addressing a crowd of about 100 followers on January 8, 2000. Another part of the tape shows Atta and Jarrah together at an Afghanistan training camp on January 18, 2000, apparently while they read their wills. [London Times, 10/1/2006] Ben Venzke, head of a group monitoring terrorism communications called the IntelCentre, says, “It is highly unlikely that al-Qaeda wanted the material to be released in this manner and it is not consistent with any previous release.” He notes that bin Laden previously said he was saving Atta’s last will for a special occasion. This release could have spoiled those plans. Dia Rashwan, an Egyptian expert on militant groups, finds it strange the cameraman focuses on bin Laden’s audience instead of on bin Laden, clearly identifying many of the people in the crowd. “Was this a video by al-Qaeda or by a security agency? I have never seen such a video.” [Associated Press, 10/3/2006] Further, it is noted on the Internet that footage of bin Laden’s speech is remarkably similar to footage of a bin Laden speech in The Road to Guantanamo, a docu-drama released in March 2006. While the film is mostly made up of reenactments, it is based on the real cases of several Guantanamo prisoners and shows one of them being asked to identify himself in the speech footage in 2003.
The newly passed Military Commissions Act (MCA—see October 17, 2006) gives the executive branch sweeping new powers sought by President Bush and Vice President Cheney since the 9/11 attacks, according to a New York Times analysis. Reporters Scott Shane and Adam Liptak write, “Rather than reining in the formidable presidential powers Mr. Bush and Vice President Dick Cheney have asserted since Sept. 11, 2001, the law gives some of those powers a solid statutory foundation. In effect it allows the president to identify enemies, imprison them indefinitely, and interrogate them—albeit with a ban on the harshest treatment—beyond the reach of the full court reviews traditionally afforded criminal defendants and ordinary prisoners. Taken as a whole, the law will give the president more power over terrorism suspects than he had before the Supreme Court decision this summer in Hamdan v. Rumsfeld that undercut more than four years of White House policy” (see June 30, 2006). The MCA “does not just allow the president to determine the meaning and application of the Geneva Conventions; it also strips the courts of jurisdiction to hear challenges to his interpretation.” Additionally, it gives Bush and his designees the absolute, unchallenged power to define anyone they choose as an “enemy combatant,” thereby stripping them of any traditional US legal protections and placing them under the far harsher and restrictive rubric of the MCA. “Over all, the legislation reallocates power among the three branches of government, taking authority away from the judiciary and handing it to the president.” Law professor Bruce Ackerman notes, “The president walked away with a lot more than most people thought. [The MCA] further entrenches presidential power” and allows the administration to declare even an American citizen an unlawful combatant subject to indefinite detention. “And it’s not only about these prisoners,” says Ackerman. “If Congress can strip courts of jurisdiction over cases because it fears their outcome, judicial independence is threatened.” [New York Times, 9/30/2006]
In late September 2006, a new book by Bob Woodward reveals that CIA Director Tenet and CIA counterterrorism chief Cofer Black gave National Security Adviser Rice their most urgent warning about a likely upcoming al-Qaeda attack (see July 10, 2001 and September 29, 2006). Tenet detailed this meeting to the 9/11 Commission in early 2004 (see January 28, 2004), but it was not mentioned in the 9/11 Commission’s final report later that year. According to the Washington Post, “Though the investigators had access to all the paperwork on the meeting, Black felt there were things the commissions wanted to know about and things they didn’t want to know about.” [Washington Post, 10/1/2006] The 9/11 Commissioners initially vigorously deny that they were not told about the meeting. For instance, 9/11 Commissioner Jamie Gorelick says she checked with commission staff who told her they were never told about a meeting on that date. She says, “We didn’t know about the meeting itself. I can assure you it would have been in our report if we had known to ask about it.” [Washington Post, 9/30/2006] Commissioner Tim Roemer says, “None of this was shared with us in hours of private interviews, including interviews under oath, nor do we have any paper on this. I’m deeply disturbed by this. I’m furious.” Commissioner Richard Ben-Veniste says the meeting “was never mentioned to us.” Philip Zelikow, the executive director of the 9/11 Commission, says the commissioners and their staff had heard nothing in their private interviews with Tenet and Black to suggest that they made such a dire presentation to Rice. “If we had heard something that drew our attention to this meeting, it would have been a huge thing.” [New York Times, 10/2/2006] However, on October 3, 2006, a transcript of Tenet’s private testimony to the 9/11 Commission is leaked to reporters and clearly shows that Tenet did warn Rice of an imminent al-Qaeda threat on July 10, 2001. Ben-Veniste, who attended the meeting along with Zelikow and other staff members, now confirms the meeting did take place and claims to recall details of it, even though he, Zelikow, and other 9/11 Commissioners had denied the existence of the meeting as recently as the day before. In the transcript, Tenet says “the system was blinking red” at the time. This statement becomes a chapter title in the 9/11 Commission’s final report but the report, which normally has detailed footnotes, does not make it clear when Tenet said it. [Washington Post, 10/3/2006] Zelikow had close ties to Rice before joining the 9/11 Commission, having co-written a book with her (see March 21, 2004), and became one of her key aides after the commission disbanded (see February 28, 2005). Zelikow does not respond to requests for comments after Tenet’s transcript surfaces. [McClatchy Newspapers, 10/2/2006; Washington Post, 10/3/2006]
The US is receiving false and misleading information about Iran’s nuclear capabilities from an Iranian dissident group labeled as a terrorist organization, says a former UN weapons inspector. The Mujahedeen-e Khalq, or MEK (see 1970s), is an exile group labeled by the US State Department as a terrorist organization, but embraced by many Washington neoconservatives, including a key group of White House officials operating inside Vice President Dick Cheney’s office and another working with Deputy Defense Secretary Paul Wolfowitz. David Albright, a former UN weapons inspector for the International Atomic Energy Agency (IAEA), says, “We should be very suspicious about what our leaders or the exile groups say about Iran’s nuclear capacity. There’s a drumbeat of allegations, but there’s not a whole lot of solid information. It may be that Iran has not made the decision to build nuclear weapons. We have to be very careful not to overstate the intelligence.” Albright says the information from MEK is somewhat more believable than the extravagantly false information provided by Ahmed Chalabi’s Iraq National Congress, which was used to bolster Bush administration allegations that Saddam Hussein’s Iraq posed a grave and imminent threat to world peace and US security (see (1994). In 2002, MEK provided critical information about Iran’s nuclear-enrichment complex at Natanz and a heavy-water production facility at Arak (see August 2002). It is unclear if Iran is pursuing a nuclear-weapons program; one UN official says of the information gleaned by the IAEA, “It’s a mixed bag.” Of MEK, he says, “The Mujahedeen Khalq appears to have some real sources inside Iran, but you can’t trust them all the time.” Iran has not been fully compliant with IAEA attempts to determine the nature and extent of its nuclear program. Nevertheless, some Congressional lawmakers say that, in light of the misinformation surrounding the claims of Iraq’s weapons programs, policy makers need to be doubly cautious about making claims and pursuing aggressive deterrence operations against Iran. Jane Harman, the ranking Democrat on the House Intelligence Committee, says, “In Iran, as well as North Korea, Syria, and so on, we need accurate, unbiased and timely intelligence. Iraq has shown that our intelligence products have a credibility problem and improvements are critically needed.” Iranian journalist Emadeddin Baghi, a columnist for the liberal Sharq newspaper who served two years in prison for criticizing the religious establishment, says that in Iran, skepticism runs deep. “Many Iranians instinctively disbelieve anything their own government says, but they also disbelieve the Americans, and what has happened in Iraq has strengthened that,” Baghi says. “Iranians see the failure to find weapons of mass destruction in Iraq, and they see the American accusations about nuclear weapons as just another pretext for other hidden aims.” [San Francisco Chronicle, 10/26/2006]

Philip Giraldi. [Source: Canal+]Former CIA official Philip Giraldi will later reveal that the office of Vice President Dick Cheney is holding up the internal release of a new National Intelligence Estimate (NIE) on Iran starting at this time, because Cheney’s people are not happy with the dissenting views contained within the document. The NIE contains widely differing views on whether or not Iran is trying to create a nuclear weapon. It also says that there is no conclusive evidence that Iran is arming Shi’ite insurgents in Iraq. Cheney’s office wants an NIE that bolsters its view of an aggressive, threatening Iran, and is not willing to accept the publication or the current Iran NIE. Giraldi says that the White House has decided not to release the NIE until after the November 2006 Congressional elections. The NIE will not be released until December 2007 (see December 3, 2007). [Inter Press Service, 11/10/2007]
Secretary of State Rice says that she does not recall the meeting on July 10, 2001, when CIA Director Tenet and other officials briefed her about the al-Qaeda threat (see July 10, 2001). “What I am quite certain of is that I would remember if I was told, as this account apparently says, that there was about to be an attack in the United States, and the idea that I would somehow have ignored that I find incomprehensible.” [Associated Press, 10/2/2006] Rice says she has no recollection of what she variously calls “the supposed meeting” and “the emergency so-called meeting.” [Editor & Publisher, 10/1/2006; McClatchy Newspapers, 10/2/2006] The Washington Post comments that “Rice added to the confusion… by strongly suggesting that the meeting may never have occurred at all—even though administration officials had conceded for several days that it had.” Hours after Rice’s latest denial, the State Department confirms that documents show Rice did attend such a meeting on that date. However, State Department spokesman Sean McCormack then says, “The briefing was a summary of the threat reporting from the previous weeks. There was nothing new.” The Washington Post notes that when it was pointed out to McCormack that Rice asked for the briefing to be shown to Defense Secretary Rumsfeld and Attorney General Ashcroft (see July 11-17, 2001), “McCormack was unable to explain why Rice felt the briefing should be repeated if it did not include new material.” [Washington Post, 10/3/2006]
NBC Nightly News reports: “Investigators tell NBC News that the water used to make [the anthrax spores] came from a northeastern US, not a foreign, source. Traces of chemicals found inside the spores revealed the materials used to grow them. And scientists have also mapped the entire DNA chain of the anthrax hoping to narrow down the laboratories where it came from. But one possible clue evaporated. The FBI concluded the spores were not coated with any chemical to make them hang longer in the air.” [MSNBC, 10/5/2006] Later in the year, Rutgers University microbiologist Richard Ebright says, “This information [about the water], if correct, would appear to narrow the field” of laboratories that the anthrax used in the 2001 anthrax attacks (see October 5-November 21, 2001) could have come from. Ebright knows of only three labs in the Northeast US that had seed cultures of the Ames strain prior to the attacks:

In two separate sessions, from October 6-11 and again from December 4-14, officials of the International Committee of the Red Cross (ICRC) interview 14 detainees newly transferred from a variety of CIA secret “black sites” to Guantanamo. The transfers followed President Bush’s acknowledgment that the CIA has maintained a number of these sites and his announced intention to have a number of the detainees sent to the Cuban facility (see September 17, 2001 and September 6, 2006).
ICRC Access - The ICRC is legally bound to monitor compliance with the Geneva Conventions and to supervise the treatment of prisoners of war; previously, it had not been allowed to see the detainees, and in some cases were never informed of their detention. The ICRC officials interview each prisoner in private, with the intention of producing “a description of the treatment and material conditions of detention of the 14 during the period they were held in the CIA detention program.”
Interviews - The 14 have been held for periods ranging “from 16 months to almost four and a half years.” The ICRC’s report, never intended for public consumption, will be released to the CIA several months later (see February 14, 2007) and revealed in a book in early 2009 (see March 15, 2009). Some of the detainees, concerned about the possible repercussions that may ensue from their discussions, ask the ICRC to withhold their names from some allegations, though most of the report attributes specific narratives and allegations to particular prisoners. Almost every allegation is independently corroborated by other, named detainees.
'Striking Similarity' - In 2009, author Mark Danner will write, quoting the ICRC report: “[I]ndeed, since the detainees were kept ‘in continuous solitary confinement and incommunicado detention’ throughout their time in ‘the black sites,’ and were kept strictly separated as well when they reached Guantanamo, the striking similarity in their stories, even down to small details, would seem to make fabrication extremely unlikely, if not impossible. ‘The ICRC wishes to underscore,’ as the writers tell us in the introduction, ‘that the consistency of the detailed allegations provided separately by each of the 14 adds particular weight to the information provided below.’”

Conclusion - The report concludes: “The allegations of ill-treatment of the detainees indicate that, in many cases, the ill-treatment to which they were subjected while held in the CIA program, either singly or in combination, constituted torture. In addition, many other elements of the ill-treatment, either singly or in combination, constituted cruel, inhuman, or degrading treatment.” Danner will write, “Such unflinching clarity, from the body legally charged with overseeing compliance with the Geneva Conventions—in which the terms ‘torture’ and ‘cruel, inhuman, and degrading treatment’ are accorded a strictly defined legal meaning—couldn’t be more significant.” [New York Review of Books, 3/15/2009]
Lieutenant General David Richards, the British general commanding NATO troops in Afghanistan, meets with Pakistani President Pervez Musharraf on October 9, 2006, in an effort to persuade him to stop the Pakistani ISI from training Taliban fighters to attack US and British soldiers in Afghanistan. The day before, he tells the Sunday Times there is “a Taliban problem on the Pakistan side of the border.… Undoubtedly something has got to happen.” Richards has evidence compiled by NATO, US, and Afghan intelligence of satellite pictures and videos showing training camps for Taliban soldiers and suicide bombers inside Pakistan. The evidence includes the exact address of where top Taliban leader Mullah Omar lives in Pakistan. Richards wants Pakistan to arrest Omar and other Taliban leaders. One senior US commander tells the Times: “We just can’t ignore it any more. Musharraf’s got to prove which side he is on.” [Sunday Times (London), 10/8/2006] What happens between Richards and Musharraf is unknown, but there are no subsequent signs of the ISI reducing its support for the Taliban or of Pakistan arresting Taliban leaders.
Joanne Mariner, an attorney with the civil liberties organization Human Rights Watch, calls the Military Commissions Act (see October 17, 2006) “exceedingly harmful” and a “grab-bag of unnecessary and abusive measures” that creates for detainees “a system of justice that is far inferior to that of the federal courts and courts-martial.” The bill does not directly address detention, Mariner writes, but does nothing to limit detention and, she believes, will be used by the administration to justify its current detention practices. Columnist Robert Novak, a recipient of several White House leaks regarding covert CIA official Valerie Plame Wilson (see July 7, 2003, July 8 or 9, 2003, (July 11, 2003), and Before July 14, 2003) and the author of the column exposing Plame Wilson (see July 14, 2003), publishes a column in the conservative Weekly Standard attacking the authors of Hubris, a book that identified former Deputy Secretary of State Richard Armitage as the original leaker of Plame Wilson’s identity (see June 13, 2003, July 8, 2003, September 6, 2006, and September 7, 2006).
Attacks Co-Author of Book - Novak focuses primarily on “stereotypical leftist activist” co-author David Corn, whom he accuses of engendering the entire Plame Wilson identity leak investigation with a column questioning the propriety of Novak’s exposure of a covert CIA official (see July 16, 2003), and writes that Corn and other “enemies of George W. Bush” used the investigation to try to “bring down a president” (Bush). Now, Novak writes, Corn is in the ironic position of having co-authored a book “that has had the effect of killing the story.” (Novak credits co-author Michael Isikoff, not Corn, with discovering the Armitage leak.) To regain traction, Novak writes, “Corn has been frantic… to depict an alternate course in which [White House official Karl] Rove, [former White House official Lewis] Libby, and Vice President Cheney attempted, by design and independently, to do what Armitage purportedly accomplished accidentally.” Armitage’s leak was a gossipy “slip-up” that occurred simultaneously with what Corn and Isikoff called “a concerted White House effort to undermine a critic of the war,” former ambassador Joseph Wilson. Novak says the “conspiracy theory” of a White House effort to denigrate and smear Wilson is specious (see June 2003, June 3, 2003, June 11, 2003, June 12, 2003, June 19 or 20, 2003, July 6, 2003, July 6-10, 2003, July 7, 2003 or Shortly After, 8:45 a.m. July 7, 2003, 9:22 a.m. July 7, 2003, July 7-8, 2003, July 11, 2003, (July 11, 2003), July 12, 2003, July 12, 2003, July 18, 2003, October 1, 2003, April 5, 2006, and April 9, 2006), and calls the book’s detailed recounting of the misdeeds of the White House surrounding the Wilson smear and the Plame Wilson exposure “tiresome.” Novak dismisses Hubris as little more than “an unmitigated apologia for the Wilsons.”
Justifies Own Cooperation with Prosecution - He goes on to justify his repeated (and unreported) testimonies before the Patrick Fitzgerald grand jury (see October 7, 2003, February 5, 2004, and September 14, 2004), saying since Fitzgerald already knew who his sources for the Plame Wilson leak were (Libby, Armitage, and CIA official Bill Harlow), “there was no use in not testifying about them,” and he “feared facing the same legal juggernaut that sent Judith Miller of the New York Times to jail” (see July 6, 2005).
Claims Plame Wilson Not Covert - Novak says that no one—Armitage, Libby, Rove, nor himself—could be prosecuted for outing Plame Wilson because she “was not a covert operative under the terms of the law” (see Fall 1992 - 1996, Late 1990s-2001 and Possibly After, April 22, 1999, (July 11, 2003), Before July 14, 2003, July 22, 2003, July 30, 2003, September 30, 2003, October 11, 2003, October 22-24, 2003, January 9, 2006, February 13, 2006, and September 6, 2006).

President Bush signs the Military Commissions Act into law. [Source: White House]President Bush signs the Military Commissions Act (MCA) into law. [White House, 10/17/2006] The MCA is designed to give the president the authority to order “enemy detainees” tried by military commissions largely outside the scope of US civil and criminal procedures. The bill was requested by the Bush administration after the Supreme Court’s ruling in Hamdi v. Rumsfeld (see June 28, 2004) that the US could not hold prisoners indefinitely without access to the US judicial system, and that the administration’s proposal that they be tried by military tribunals was unconstitutional (see June 28, 2004). [FindLaw, 10/9/2006] It is widely reported that the MCA does not directly apply to US citizens, but to only non-citizens defined as “enemy combatants. [CBS News, 10/19/2006] However, six months later, a Bush administration lawyer will confirm that the administration believes the law does indeed apply to US citizens (see February 1, 2007).
Sweeping New Executive Powers - The MCA virtually eliminates the possibility that the Supreme Court can ever again act as a check on a president’s power in the war on terrorism. Similarly, the law gives Congressional approval to many of the executive powers previously, and unilaterally, seized by the Bush administration. Former Justice Department official John Yoo celebrates the MCA, writing, “Congress… told the courts, in effect, to get out of the war on terror” (see October 19, 2006). [Savage, 2007, pp. 319, 322]
'Abandoning' Core 'Principles' - The bill passed the Senate on a 65-34 vote, and the House by a 250-170 vote. The floor debate was often impassioned and highly partisan; House Majority Leader John Boehner (R-OH) called Democrats who opposed the bill “dangerous,” and Senate Judiciary Committee member Patrick Leahy (D-VT) said this bill showed that the US is losing its “moral compass.” Leahy asked during the debate, “Why would we allow the terrorists to win by doing to ourselves what they could never do, and abandon the principles for which so many Americans today and through our history have fought and sacrificed?” Senate Judiciary Committee chairman Arlen Specter (R-PA) had said he would vote against it because it is “patently unconstitutional on its face,” but then voted for it, saying he believes the courts will eventually “clean it up.” Specter’s attempt to amend the bill to provide habeas corpus rights for enemy combatants was defeated, as were four Democratic amendments. Republicans have openly used the debate over the MCA as election-year fodder, with House Speaker Dennis Hastert (R-IL) saying after the vote that “House Democrats have voted to protect the rights of terrorists,” and Boehner decrying “the Democrats’ irrational opposition to strong national security policies.” Democrats such as Senator Barack Obama (D-IL) say they will not fight back at such a level. “There will be 30-second attack ads and negative mail pieces, and we will be called everything from cut-and-run quitters to Defeatocrats, to people who care more about the rights of terrorists than the protection of Americans,” Obama says. “While I know all of this, I’m still disappointed, and I’m still ashamed, because what we’re doing here today—a debate over the fundamental human rights of the accused—should be bigger than politics.” [Washington Post, 10/19/2006] After winning the vote, Hastert accused Democrats who opposed the bill of “putting their liberal agenda ahead of the security of America.” Hastert said the Democrats “would gingerly pamper the terrorists who plan to destroy innocent Americans’ lives” and create “new rights for terrorists.” [New York Times, 10/19/2006]
Enemy Combatants - The MCA applies only to “enemy combatants.” Specifically, the law defines an “unlawful enemy combatant” as a person “who has engaged in hostilities or who has purposefully and materially supported hostilities against the United States or its co-belligerents,” and who is not a lawful combatant. Joanne Mariner of Human Rights Watch says the definition far exceeds the traditionally accepted definition of combatant as someone who directly participates in hostilities. But under the MCA, someone who provides “material support” for terrorists—whether that be in the form of financial contributions or sweeping the floors at a terrorist camp—can be so defined. Worse, the label can be applied without recourse by either Bush or the secretary of defense, after a “competent tribunal” makes the determination. The MCA provides no guidelines as to what criteria these tribunals should use. Taken literally, the MCA gives virtually unrestricted power to the tribunals to apply the label as requested by the president or the secretary. Mariner believes the definition is both “blatantly unconstitutional” and a direct contradiction of centuries of Supreme Court decisions that define basic judicial rights. [FindLaw, 10/9/2006] Under this definition, the president can imprison, without charge or trial, any US citizen accused of donating money to a Middle East charity that the government believes is linked to terrorist activity. Citizens associated with “fringe” groups such as the left-wing Black Panthers or right-wing militias can be incarcerated without trial or charge. Citizens accused of helping domestic terrorists can be so imprisoned. Law professor Bruce Ackerman calls the MCA “a massive Congressional expansion of the class of enemy combatants,” and warns that the law may “haunt all of us on the morning after the next terrorist attack” by enabling a round of mass detentions similar to the roundup of Japanese-American citizens during World War II. [Savage, 2007, pp. 322]
Military Commissions - The MCA mandates that enemy combatants are to be tried by military commissions, labeled “regularly constituted courts that afford all the necessary ‘judicial guarantees which are recognized as indispensable by civilized peoples’ for purposes of common Article 3 of the Geneva Conventions.” The commissions must have a minimum of five commissioned military officers and a military judge; if death is a possible penalty, the commissions must have at least 12 officers. The defendant’s guilt must be proven beyond a reasonable doubt; convictions require a two-thirds vote. Sentences of beyond 10 years require a three-quarters vote, and death penalties must be unanimously voted for. Defendants may either represent themselves or by military or civilian counsel. The court procedures themselves, although based on standard courts-martial proceedings, are fluid, and can be set or changed as the secretary of defense sees fit. Statements obtained through methods defined as torture are inadmissible, but statements take by coercion and “cruel treatment” can be admitted. The MCA sets the passage of the Detainee Treatment Act (DTA—see December 15, 2005) as a benchmark—statements obtained before the December 30, 2005 enactment of that law can be used, even if the defendant was “coerced,” if a judge finds the statement “reasonable and possessing sufficient probative value.” Statements after that date must have been taken during interrogations that fall under the DTA guidelines. Defendants have the right to examine and respond to evidence seen by the commission, a provision originally opposed by the administration. However, if the evidence is classified, an unclassified summary of that material is acceptable, and classified exculpatory evidence can be denied in lieu of what the MCA calls “acceptable substitutes.” Hearsay evidence is admissible, as is evidence obtained without search warrants. Generally, defendants will not be allowed to inquire into the classified “sources, methods, or activities” surrounding evidence against them. Some human rights activists worry that evidence obtained through torture can be admitted, and the fact that it was obtained by torture, if that detail is classified, will not be presented to the court or preclude the evidence from being used. Public access to the commissions will be quite limited. Many experts claim these commissions are illegal both by US constitutional law and international law. [FindLaw, 10/9/2006]
Secret Courts - The military tribunals can be partially or completely closed to public scrutiny if the presiding judge deems such an action necessary to national security. The government can convey such concerns to the judge without the knowledge of the defense. The judge can exclude the accused from the trial if he deems it necessary for safety or if he decides the defendant is “disruptive.” Evidence can be presented in secret, without the knowledge of the defense and without giving the defense a chance to examine that evidence, if the judge finds that evidence “reliable.” And during the trial, the prosecution can at any time assert a “national security privilege” that would stop “the examination of any witness” if that witness shows signs of discussing sensitive security matters. This provision can easily be used to exclude any potential defense witness who might “breach national security” with their testimony. Author and investigative reporter Robert Parry writes, “In effect, what the new law appears to do is to create a parallel ‘star chamber’ system for the prosecution, imprisonment, and elimination of enemies of the state, whether those enemies are foreign or domestic.” [Consortium News, 10/19/2006]
Appeals - Guilty verdicts are automatically appealed to a Court of Military Commission Review, consisting of three appellate military justices. The DC Circuit Court of Appeals has extremely limited authority of review of the commissions; even its authority to judge whether a decision is consistent with the Constitution is limited “to the extent [that the Constitution is] applicable.”
Types of Crimes - Twenty-eight specific crimes fall under the rubric of the military commissions, including conspiracy (not a traditional war crime), murder of protected persons, murder in violation of the bill of war, hostage-taking, torture, cruel or inhuman treatment, mutilation or maiming, rape, sexual abuse or assault, hijacking, terrorism, providing material support for terrorism, and spying. CIA Abuses - The MCA, responding to the recent Supreme Court decision of Hamdan v. Rumsfeld (see June 30, 2006) that found the CIA’s secret detention program and abusive interrogation practices illegal, redefines and amends the law to make all but the most pernicious interrogation practices, even those defined as torture by the War Crimes Act and the Geneva Conventions, legal. The MCA actually rules that the Geneva Conventions are all but unenforceable in US courts. It also provides retroactive protection under the law to all actions as far back as November 1997. Under the MCA, practices such as waterboarding, stress positioning, and sleep deprivation cannot be construed as torture. [FindLaw, 10/9/2006] The MCA even states that rape as part of interrogations cannot be construed as torture unless the intent of the rapist to torture his victim can be proven, a standard rejected by international law. The MCA provides such a narrow definition of coercion and sexual abuse that most of the crimes perpetrated at Abu Ghraib are now legal. [Jurist, 10/4/2006] Although the MCA seems to cover detainee abuse for all US agencies, including the CIA, Bush says during the signing of the bill, “This bill will allow the Central Intelligence Agency to continue its program for questioning key terrorist leaders and operatives.” International law expert Scott Horton will note, “The administration wanted these prohibitions on the military and not on the CIA, but it did not work out that way.” Apparently Bush intends to construe the law to exempt the CIA from its restrictions, such as they are, on torture and abuse of prisoners. No Habeas Corpus Rights - Under the MCA, enemy combatants no longer have the right to file suit under the habeas corpus provision of US law. This means that they cannot challenge the legality of their detention, or raise claims of torture and mistreatment. Even detainees who have been released can never file suit to seek redress for their treatment while in US captivity. [FindLaw, 10/25/2006]
Retroactive Immunity - The administration added a provision to the MCA that rewrote the War Crimes Act retroactively to November 26, 1997, making any offenses considered war crimes before the MCA is adopted no longer punishable under US law. Former Nixon White House counsel John Dean will write in 2007 that the only reason he can fathom for the change is to protect administration officials—perhaps including President Bush himself—from any future prosecutions as war criminals. Dean will note that if the administration actually believes in the inherent and indisputable powers of the presidency, as it has long averred, then it would not worry about any such criminal liability. The New York Times pens an editorial issuing a grim warning about the ramifications of the newly passed Military Commission Act (MCA—see October 17, 2006). The editorial calls the law’s stripping of habeas corpus rights for so-called “enemy combatants” “undemocratic.” It criticizes the highly charged rhetoric of the Republicans who attacked Democrats in opposition to the law as part of the Republican Party’s “scare-America-first strategy” for the upcoming midterm elections. The Times notes that President Bush misled the country into believing that the MCA is the only way the country has of adequately putting 9/11 suspects on trial: “The truth is that Mr. Bush could have done that long ago, but chose to detain them illegally at hidden CIA camps to extract information. He sent them to Guantanamo only to stampede Congress into passing the new law. The 60 or so men at Guantanamo who are now facing tribunals—out of about 450 inmates—also could have been tried years ago if Mr. Bush had not rebuffed efforts by Congress to create suitable courts. He imposed a system of kangaroo courts that was more about expanding his power than about combating terrorism.” The editorial criticizes Bush’s new “separate system of justice for any foreigner whom Mr. Bush chooses to designate as an ‘illegal enemy combatant,” one that “raises insurmountable obstacles for prisoners to challenge their detentions [and] does not require the government to release prisoners who are not being charged, or a prisoner who is exonerated by the tribunals.” However, the editorial gives false comfort to its readers by asserting that the MCA “does not apply to American citizens, but it does apply to other legal United States residents.” [New York Times, 10/19/2006]
Times Errs in Stating MCA Does Not Apply to US Citizens - Most other mainstream media outlets do not mention the possibility of the MCA applying to US citizens. But on the same day as the Times editorial, author and investigative journalist Robert Parry gives a powerful argument that the MCA can indeed be applied to them. The MCA reads in part, “Any person is punishable as a principal under this chapter who commits an offense punishable by this chapter, or aids, abets, counsels, commands, or procures its commission.… Any person subject to this chapter who, in breach of an allegiance or duty to the United States, knowingly and intentionally aids an enemy of the United States… shall be punished as a military commission… may direct.” The legal meaning of “any person,” Parry notes, clearly includes US citizens, particularly those who may act “in breach of an allegiance or duty to the United States.” Parry asks, “Who has ‘an allegiance or duty to the United States’ if not an American citizen? That provision would not presumably apply to Osama bin Laden or al-Qaeda, nor would it apply generally to foreign citizens. This section of the law appears to be singling out American citizens.” If an American citizen is charged with a crime under the MCA, that citizen, like the foreign nationals currently laboring under the weight of the law, cannot challenge their detention and charges under the habeas corpus provisions of US law, and cannot expect a fair trial. They will not be given the chance to appeal their convictions until they are prosecuted, convicted, and sentenced. And since the MCA defendant has no right to a “speedy trial,” that defendant cannot expect to be granted an appeal in any reasonable length of time. In effect, an American citizen, like a foreign national charged under the MCA, can be imprisoned indefinitely without recourse to the US judiciary.
Potential to Jail Media Leakers and Reporters - One aspect of the MCA that has not been widely discussed, Parry notes, is the provision that would allow the incarceration of “any person” who “collects or attempts to collect information by clandestine means or while acting under false pretenses, for the purpose of conveying such information to an enemy of the United States.” That provision is tremendously vague, and could easily be stretched to fit, for example, the whistleblowers who revealed the existence of the NSA’s warrantless wiretapping program to the Times (see December 15, 2005) and the reporters and editors who published the story based on those revelations. [Consortium News, 10/19/2006] Six months later, a Justice Department lawyer will confirm that the Bush administration believes MCA does indeed apply to US citizens (see February 1, 2007).
Keith Olbermann. [Source: Spidered News.com]MSNBC political commentator Keith Olbermann says that the nation has passed a grim milestone with the passage of the Military Commissions Act (MCA) (see October 17, 2006). By accepting this law, Olbermann says, the nation has accepted that to fight the terrorists, the US government must become “just a little bit like the terrorists.” But the ultimate threat to the nation is not terrorists, Olbermann says, it is George W. Bush himself. “We have a long and painful history of ignoring the prophecy attributed to Benjamin Franklin that ‘those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty nor safety.’” Speaking directly to President Bush, Olbermann continues: “But even within this history we have not before codified the poisoning of habeas corpus (see March 28, 2007), that wellspring of protection from which all essential liberties flow. You, sir, have now befouled that spring. You, sir, have now given us chaos and called it order. You, sir, have now imposed subjugation and called it freedom. For the most vital, the most urgent, the most inescapable of reasons. And—again, Mr. Bush—all of them, wrong.” The MCA gives Bush a “blank check drawn against our freedom to a man who may now, if he so decides, declare not merely any non-American citizens ‘unlawful enemy combatants’ and ship them somewhere—anywhere—but may now, if he so decides, declare you an ‘unlawful enemy combatant’ and ship you somewhere—anywhere” (see September 28, 2006). Habeas corpus is now “gone” for those in the prison camps, Olbermann says, and Geneva Conventions protections are “optional.” He concludes: “The moral force we shined outwards to the world as an eternal beacon, and inwards at ourselves as an eternal protection? Snuffed out. These things you have done, Mr. Bush, they would be ‘the beginning of the end of America.’” [MSNBC, 10/19/2006]
Exercising its new authority under the just-signed Military Commissions Act (MCA—see October 17, 2006), the Bush administration notifies the US District Court in Washington that it no longer has jurisdiction to consider 196 habeas corpus petitions filed by Guantanamo detainees. Many of these petitions cover multiple detainees. According to the MCA, “no court, justice, or judge” can consider those petitions or other actions related to treatment or imprisonment filed by anyone designated as an enemy combatant, now or in the future. The MCA is already being challenged as unconstitutional by several lawyers representing Guantanamo detainees. The MCA goes directly against two recent Supreme Court cases, Rasul v. Bush (see June 28, 2004) and Hamdan v. Rumsfeld (see June 30, 2006), which provide detainees with habeas corpus and other fundamental legal rights. Many Congressional members and legal experts say that the anti-habeas provisions of the MCA are unconstitutional. For instance, Senator Arlen Specter (R-PA) notes that the Constitution says the right of any prisoner to challenge detention “shall not be suspended” except in cases of “rebellion or invasion.” [Washington Post, 10/20/2006] Law professor Joseph Margulies, who is involved in the detainee cases, says the administration’s persistence on the issue “demonstrates how difficult it is for the courts to enforce [the clause] in the face of a resolute executive branch that is bound and determined to resist it.” Vincent Warren of the Center for Constitutional Rights, which represents many of the detainees, expects the legal challenges to the law will eventually wind up before the Supreme Court. After an investigation into whether an Israeli lobbying organization improperly tried to influence House Minority Leader Nancy Pelosi (D-CA) into naming Jane Harman (D-CA) as the chairman of the House Intelligence Committee (see Summer 2005 and October 2005) becomes public knowledge, Harman calls the allegations “irresponsible, laughable, and scurrilous.” Former Solicitor General Theodore Olson, a Republican just hired by Harman to represent her in the matter, tells Time reporter Timothy Burger: “Congresswoman Harman has asked me to follow up on calls you’ve had. She is not aware of any such investigation, does not believe that it is occurring, and wanted to make sure that you and your editors knew that as far as she knows, that’s not true.… No one from the Justice Department has contacted her.” Burger notes that “[i]t is not, however, a given that Harman would know that she is under investigation.” Olson confirms that Harman hired him because even though she doesn’t believe the media reports of the investigation, she takes the possibility seriously. The American Israel Public Affairs Committee (AIPAC), allegedly Harman’s partner in the scheme, also denies any wrongdoing, and says it takes no position on the question of who wins the committee assignment, which was perceived to be a contest between Harman and fellow committee member Alcee Hastings (D-FL). AIPAC spokesman Patrick Dorton says: “Both Congressman Hastings and Congresswoman Harman are strong leaders on issues of importance to the pro-Israel community and would be exemplary Democratic leaders for the House intelligence committee. AIPAC would never engage in a quid pro quo in relation to a federal investigation or any federal matter and the notion that it would do so is preposterous. AIPAC is not aware that the Justice Department is looking into issues involving the intelligence committee, and has not been asked any questions or contacted by the government on this matter, but certainly would cooperate with any inquiry.” Dorton adds that AIPAC has previously been assured that the organization and its current employees are not being investigated. Iran is unlikely to be able to develop a nuclear weapon before 2015, says the head of Germany’s intelligence service. Bundesnachrichtendienst (BND) head Ernst Uhrlau tells a security conference, “It is difficult to give an exact estimate of the time,” but “[a]ccording to the current rate of enrichment, the Islamic Republic will not have sufficient amounts of highly enriched uranium with which to build atomic weapons before 2010. For a nuclear bomb we are looking at around 2015.” Uhrlau’s estimate echoes the findings of a recent US intelligence report on Iran’s nuclear weapons program (see August 2, 2005). Iran has long insisted that its nuclear program is strictly for the production of electricity. [Reuters, 10/24/2006]
In an interview with WDAY’s Scott Heinen, Vice President Dick Cheney says it was a “no-brainer for me” to authorize waterboarding of suspected terrorists (see April 2002 and After and Summer 2003). Cheney says that since waterboarding and other brutal methods are not torture, as he defines the term (see Mid-March 2002), the entire issue is not really an issue. “We don’t torture,” he says. “That’s not what we’re involved in. We live up to our obligations in international treaties that we’re party to, and so forth. But the fact is, you can have a fairly robust interrogation program without torture, and we need to be able to do that.” [Savage, 2007, pp. 154-155; Financial Times, 10/26/2008] After Cheney’s statement causes a welter of criticism among lawmakers and media figures, the White House says Cheney was not talking about waterboarding, and insists that the US does not torture. Cheney calls reporters to bolster the denial. “I did not talk about specific techniques and won’t,” he says. “I didn’t say anything about waterboarding.… He [Heinen] didn’t even use that phrase.” Human Rights Watch says Cheney’s remarks are “the Bush administration’s first clear endorsement” of waterboarding. Vice President Cheney linked the NSA’s warrantless surveillance program to the case of 9/11 hijackers Khalid Almihdhar and Nawaf Alhazmi. [Source: White House]Vice President Dick Cheney justifies an NSA program for warrantless surveillance of conversations between the US and other countries by referring to communications between 9/11 hijackers Khalid Almihdhar and Nawaf Alhazmi in the US and an al-Qaeda communications hub in Yemen (see Early 2000-Summer 2001). The calls were intercepted by the NSA, but this did not help the US roll up the plot. Echoing remarks previously made by President Bush (see December 17, 2005), Cheney says: “If you’ll recall, the 9/11 Commission focused criticism on the nation’s inability to uncover links between terrorists at home and terrorists overseas [note: the 9/11 Commission’s final report does not actually say this (see December 17, 2005)]. The term that was used is ‘connecting the dots’—and the fact is that one small piece of data might very well make it possible to save thousands of lives. If this program had been in place before 9/11, we might have been able to prevent it because we had two terrorists living in San Diego, contacting terrorist-related numbers overseas.” [Office of the Vice President, 8/25/2006] Before 9/11, the NSA was entitled to pass on information about the calls to the FBI, but did not do so, even though the FBI had specifically asked for information about calls between the communications hub in Yemen and the US (see Late 1998 and (Spring 2000)). Various explanations for this failure are offered after 9/11 (see Summer 2002-Summer 2004 and March 15, 2004 and After).

Walton arguing that Majid Khan, a Guatanamo detainee who was held in the secret CIA prison system for three years, cannot be allowed access to lawyers because he may reveal what interrogation techniques were used on him. CIA Information Review Officer Marilyn A. Dorn says in an affidavit that since “detained by CIA in this program, he may have come into possession of information, including locations of detention, conditions of detention, and alternative interrogation techniques that is classified at the TOP SECRET//SCI [sensitive compartmented information] level.” [Washington Post, 11/4/2006]
MSNBC reports that Mohammed al-Khatani, the alleged would-be twentieth 9/11 hijacker, will likely never be put on trial. A US army investigation concluded that he “was forced to wear a bra. He had a thong placed on his head. He was massaged by a female interrogator who straddled him like a lap dancer. He was told that his mother and sisters were whores. He was told that other detainees knew he was gay. He was forced to dance with a male interrogator. He was strip-searched in front of women. He was led on a leash and forced to perform dog tricks. He was doused with water. He was prevented from praying. He was forced to watch as an interrogator squatted over his Koran.” Mark Fallon, head of the Pentagon’s Criminal Investigation Task Force, claims that he was told by other officials several times not to worry building a legal case against al-Khatani since there would never be a trial against him due to the interrogation techniques used on him. [MSNBC, 10/26/2006] According to al-Khatani’s lawyer, al-Khatani appears to be a broken man, who “painfully described how he could not endure the months of isolation, torture and abuse, during which he was nearly killed, before making false statements to please his interrogators.” [Time, 3/3/2006]

[Source: BBC]The US launches a Predator drone missile strike on a madrassa (religious school) in the Bajour district of Pakistan’s tribal region, then Pakistan sends in helicopters to attack the survivors. The aim is to kill al-Qaeda second-in-command Ayman al-Zawahiri, but he is not there. Pakistani officials initially claim that a number of al-Qaeda operatives are killed, including Abu Ubaida al-Masri, an operational leader. But the next day they only say that some Taliban members are killed. [ABC News, 10/30/2006; ABC News, 10/31/2006] The attack is said to have killed 82, many of them students at the madrassa located in Chenagai, a hamlet of Damadola village, which had been hit by a Predator strike earlier in the year (see January 13, 2006). [London Times, 11/26/2006]
On September 5, 2006, the government of Pakistan signs an agreement known as the Waziristan Accord with Taliban-linked militants in the tribal area of Pakistan near the border of Afghanistan known as North Waziristan (see September 5, 2006), and President Bush quickly gave his public approval to the deal (see September 7, 2006). By November 2006, Lt. Gen. Karl Eikenberry, head of US forces in Afghanistan, says that the number of Taliban attacks out of North Waziristan has tripled since the deal was signed. On December 26, US Assistant Secretary of State Richard Boucher says, “The Taliban have been able to use [the tribal regions] for sanctuary, and for command and control, and for regrouping and supply.” The State Department decides that the deal has been a failure for US policy, just as two previous deals with militants in the border region had been. But the Pakistani government continues to stick to the terms of the deal well into 2007. [Rashid, 2008, pp. 277]
The CIA acknowledges that it has operated under the rubric of two secret Bush administration documents that authorized it to detain and interrogate terrorism suspects overseas. Since 2004, the agency has refused to either confirm or deny the existence of the documents, and has argued in court that to make such an acknowledgement would jeopardize national security. The American Civil Liberties Union, which has fought the CIA in court over the documents, says in a statement by its executive director, Anthony Romero: “The CIA’s sudden reversal on these secret directives is yet more evidence that the Bush administration is misusing claims of national security to avoid public scrutiny. Confusion about whether such a presidential order existed certainly led to the torture and abuse scandal that embarrassed America. With a new Congress and renewed subpoena power, we now need to look up the chain of command.” One of the documents is a secret executive order signed by President Bush authorizing the CIA to set up “black site” detention facilities overseas (see September 17, 2001), and the other is a Justice Department legal analysis specifying interrogation methods that CIA interrogators could use against top al-Qaeda suspects. In legal papers previously filed in court, the CIA claimed that national security would be gravely injured if the CIA were compelled to admit or deny even an “interest” in interrogating detainees. Today, however, the agency acknowledges the existence of the two documents. It continues to withhold the documents themselves; their contents remain unknown to the public. The ACLU’s Jameel Jaffer says: “We intend to press for the release of both of these documents. If President Bush and the Justice Department authorized the CIA to torture its prisoners, the public has a right to know.” [American Civil Liberties Union, 11/14/2006]
Vice President Dick Cheney asks a federal judge to dismiss a lawsuit brought against him by a former CIA official, Valerie Plame Wilson, who says the White House leaked her identity to the press (see July 13, 2006). He is joined in his request for dismissal by his former chief of staff, Lewis Libby, who is also named in the lawsuit. According to a report by the Associated Press, Cheney’s lawyers say the lawsuit “invented constitutional rights, intruded on national security discussions, and came two years after the statute of limitations had expired.” Cheney’s lawyers also say Plame Wilson has no grounds to bring the lawsuit, and even if she does, Cheney has “qualified immunity” from civil suits by his position as a senior member of the executive branch, and is “absolutely immune from suits for civil damages.” Cheney’s lawyers write in their brief: “Plaintiffs invite the judicial branch to permit intrusive discovery into those communications and to discern which among them might be, as a matter of tort law, wrongful and which not.… Such an inquiry cannot be squared with basic separation of powers principals.” [Associated Press, 11/14/2006; MSNBC, 11/14/2006; US District Court for the District of Columbia, 11/14/2006 ; US District Court for the District of Columbia, 11/14/2006 ; US District Court for the District of Columbia, 11/14/2006 ]
Speaking publicly before a Congressional committee, CIA Director Michael Hayden says that “the lessons learned in Iraq are being applied to Afghanistan” by al-Qaeda. For instance, the number of suicide bombings in Afghanistan is greatly increasing (see 2004-2007). [Rashid, 2008, pp. 282, 442] The Taliban also greatly increase the use of IEDs (improvised explosive devices), the roadside bombs which have proven highly effective in Iraq. The use of IED bombings rises from 530 times in 2005 to 1,297 in 2006. [Rashid, 2008, pp. 367]
The Director of the Central Intelligence Agency, General Michael V. Hayden, appearing before a hearing of the Senate Armed Services Committee to address the current situation in Iraq and Afghanistan, states that the Afghan government’s outreach and provision of security to the country is inadequate. Hayden stresses that the key to making progress in Afghanistan is bolstering security, stating, “The capacity of the government needs to be strengthened to deliver basic services to the population—especially security.” He notes that there are not enough properly trained, equipped, or well-paid security forces in Afghanistan. “Even though the Afghan National Army continues to become larger, stronger, and more experienced, progress has been slow and little progress has been made in constructing an effective Afghan National Police force,” reads his prepared statement. [Senate Armed Services Committee, 11/15/2006 ]
After ruling that the prosecution’s proposed summations and substitutions for classified documents requested by the defense are inadequate (see November 13, 2006), Judge Reggie Walton issues an order detailing how much classified evidence the Lewis Libby defense team may have access to in its preparations to defend its client against perjury and obstruction charges. It is up to the prosecution and defense lawyers to decide how much, or how little, of the classified materials to redact before presenting them in the trial. Prosecutor Patrick Fitzgerald has accused the Libby defense team of engaging in “graymail,” an attempt to derail the prosecution by threatening to reveal national security secrets (see After October 28, 2005, January 31, 2006, February 6, 2006, and (February 16, 2006)). Walton’s ruling is sealed, so it is unclear what will and will not be made available to Libby. [Associated Press, 11/15/2006] The public may learn of some of Walton’s ruling in December, when intelligence and national security agencies report back to him as to the status of the classified materials sought by Libby. Walton acknowledges that he has had to keep some information out of the public view, writing, “While this court has strived to make the proceedings in this action as transparent as possible, because the defendant seeks to introduce at trial evidence that is currently classified, this court has been required to close to the public may proceedings and seal a substantial number of pleadings.” [MSNBC, 11/16/2006] Walton will release his ruling, in redacted form (see December 1, 2006).
The International Atomic Energy Agency is skeptical of the claim that Iran has made further progress in its uranium enrichment research program (see Mid-November, 2006). However, Iranian leader Mahmoud Ahmadinejad’s defiant tone does nothing to lessen US suspicions about Iran’s nuclear ambitions. A European diplomat says: “There is no evidence of a large-scale covert enrichment program inside Iran. But the Iranians would not have launched themselves into a very dangerous confrontation with the West on the basis of a weapons program that they no longer pursue. Their enrichment program makes sense only in terms of wanting nuclear weapons. It would be inconceivable if they weren’t cheating to some degree. You don’t need a covert program to be concerned about Iran’s nuclear ambitions. We have enough information to be concerned without one. It’s not a slam dunk, but it’s close to it.” [New Yorker, 11/27/2006]
Responding to Iranian claims that it is progressing in its attempts to enrich uranium (see Mid-November, 2006) and the International Atomic Energy Agency’s skepticism of the claims (see Mid-November 2006), analysts and officials have alternative explanations. Whether peaceful or not, Iran’s nuclear program is a source of great national pride, and its popularity bolsters President Mahmoud Ahmadinejad’s rather tenuous grip on power. A former US intelligence official says it is not inconceivable that Ahmadinejad would welcome a limited military strike against Iran by the US, especially if it does not destroy its nuclear program. Such an attack would shore up Iran’s position in the Islamic world. “They learned that in the Iraqi experience, and relearned it in southern Lebanon,” the official says, referring to both the US debacle in Iraq and the resurgent popularity of Hezbollah’s leader, Hassan Nasrallah, after Israel’s 2006 strike at the group in Lebanon. Indeed, the former official says, a US attack on Iran could possibly serve as a rallying point to unite the divided Sunni and Shi’ite populations. “An American attack will paper over any differences in the Arab world, and we’ll have Syrians, Iranians, Hamas, and Hezbollah fighting against us—and the Saudis and the Egyptians questioning their ties to the West,” he says. “It’s an analyst’s worst nightmare—for the first time since the caliphate there will be common cause in the Middle East.” A Pentagon consultant says the CIA does not believe that even a large-scale bombing attack will eradicate Iran’s nuclear program, and a limited campaign of subversion and sabotage plays into Iran’s hands, bolstering support for Iran’s theocratic leaders and “deepening anti-American Muslim rage.” [New Yorker, 11/27/2006]
Special counsel Patrick Fitzgerald notifies the court that he plans to appeal a recent ruling that grants the Lewis Libby defense team wide access to classified documents (see November 15, 2006). As a result, the scheduled trial date for Libby—early January 2007—may be delayed. The US Court of Appeals has a brief window of time to consider the Fitzgerald appeal without delaying the trial. [Washington Post, 11/23/2006] Judge Reggie Walton will issue strict limitations on what Libby can introduce at trial (see December 11, 2006).
Scientist Bruce Ivins begins to believe that the FBI anthrax attacks investigation is turning its focus towards him. He is correct, but it is unclear how he knows this (the FBI begins openly monitoring him at some point in 2007 (see Autumn 2007-July 29, 2008)). At USAMRIID, the US Army’s top bioweapons laboratory, he tells colleagues that the FBI might be trying to set him up to take the fall for the attacks. His former boss Jeffrey Adamovicz will later recall that Ivins begins to poke holes in the FBI’s efforts. For instance, Ivins says a positive DNA match between the anthrax in the letters and anthrax at USAMRIID would mean little, “because those labs are shared.” [Wall Street Journal, 8/7/2008] It is unclear why the FBI is suspecting Ivins already, because a match between the anthrax used in the attacks and anthrax held by him will not be made until early 2007 (see Early 2007).
The US intelligence community begins plumbing the data they have compiled on Iran’s nuclear weapons program in an attempt to shore up the Bush administration’s premature conclusion that Iran is on the verge of producing a nuclear weapon. Instead, their conclusions are that Iran shut down its nuclear weapons program in 2003. In the process, White House aides begin a program of “deep dives,” or special briefings for President Bush to meet with not only his advisers but the actual analysts who study Iranian intelligence data, in an attempt to allow Bush to “get his hands dirty” with real intelligence and not just pre-digested summaries. Bush is dismayed at the lack of solid intelligence on Iran’s nuclear program and asks for more. When the intelligence community does provide more, it finds more and more evidence that Iran had shut down its nuclear weapons program years before. Those conclusions will be released in a National Intelligence Estimate (NIE) a year later (see December 3, 2007).
Troubling Conclusions, White House Spin - Bush and his top officials don’t like the findings; if true, the reports disprove the entirety of the administration’s push to define Iran as an imminent threat to the Middle East. White House officials are initially skeptical, believing that the intelligence community might be a victim of Iranian disinformation. The intelligence agencies create a special “red team” of analysts to thoroughly test and, if possible, discredit the information. They are unable to do so. “They tried to figure out what exactly it would take to perpetrate that kind of deception, how many people would be involved, how they would go about doing it, when it would have been set up and so forth,” says one intelligence official. Analysts “scrubbed and rescrubbed” more than 1,000 pieces of evidence but conclude Iran’s program really had been shut down. Faced with that conclusion, the White House decides to focus on the findings that confirm their suspicions—that Iran did have a secret weapons program that could be restarted again. No one in the White House suggests that Bush tone down his rhetoric or change his policies towards Iran. Director of National Intelligence Mike McConnell decides to keep the new findings secret, the same position adopted by Vice President Cheney (see October 2006 and November 10, 2007). Only the Israelis are told of the new findings; Congress, the US’s European allies, and the UN’s monitoring agency, the International Atomic Energy Agency (IAEA) are told nothing. McConnell will reluctantly change his mind out of a fear of leaks and possible charges of a coverup. That decision may come back to haunt the administration, particularly with the ill-will it will create among the US’s allies. Former State Department nonproliferation official Robert Einhorn says, “The administration is going to pay a price for not allowing allies in on it at an earlier date. The French had carried the administration’s water on this issue and really went out on a limb to get the European Union to adopt tough sanctions. And now the rug has been pulled out from under them.”
New NIE Draft Sparks Controversy - An NIE the year before (see August 2, 2005) had led the US to conclude that Iran was actively working on a nuclear weapons program. Congressional Democrats, not entirely convinced by the NIE’s conclusions and increasingly resistant to Bush’s push for confrontation with Iran, asks for a new NIE. Bush wants the new NIE to confirm his accusations and, in one official’s words, “get more information on Iran so we know what they’re up to.” The 2005 NIE had been based largely on information about Iran’s “Project 1-11,” a program that Iran is apparently pursuing to retrofit a ballistic missile to carry nuclear warheads (see Summer 2004). But no new information on Project 1-11 has been secured in three years, and the administration insists on new confirmations. “They just wouldn’t budge,” one agency official recalls. A new draft is completed in June, provoking heated discussions among agency and administration officials. CIA director Michael Hayden and NSA director Keith Alexander begin directing their agencies to closely monitor Iranians who were involved in their country’s nuclear program. Soon, communications intercepts from key Iranian officials indicate that the program had been mothballed in 2003. Some of the officials discuss their belief that the program may never be restarted.
Evolving NIE - As the draft NIE evolves, McConnell, with the assistance of his deputies Thomas Fingar and Donald Kerr, both national security veterans, lay down ground rules. One official later says that McConnell “quickly got the mantra down: ‘We must make a clear distinction between what we know and don’t know and what we judge to be the case.’” The internal debate over the NIE is sharp and often contentious. McConnell will finally inform Bush of the new conclusions—that Iran stopped its nuclear weapons program in 2003—in August (see December 5, 2007 and December 3-4, 2007). In September, House and Senate intelligence committee members are informed as well. A September draft radically differs from the June version, based in large part on the communications intercepts and the exhaustive analysis on the data possessed by the CIA and NIE. The chief analysts are grilled by Hayden and his deputy Stephen Kappes, but the analyses stand up. Cheney, National Security Adviser Stephen Hadley, and other key officials will be given a preliminary briefing on the new NIE on November 15; Bush, finalizing a Middle East peace conference in which he will try to rally Middle Eastern countries against Iran, is not officially told of the new NIE until November 28. Bush immediately tells Israeli Prime Minister Ehud Olmert (see November 26-28, 2007), and Cheney appraises Israeli Foreign Minister Ehud Barak. Discussions about whether or not to keep the NIE secret lead to McConnell’s decision to make a declassified version public. A top intelligence official says, “We knew it would leak, so honesty required that we get this out ahead, to prevent it from appearing to be cherry picking.” [Washington Post, 12/8/2007]

[Source: National Defense Intelligence College]A study just released by the Intelligence Science Board, a wing of the National Defense Intelligence College, suggests that after the 9/11 attacks, when US military and intelligence agency interrogators were asked to use harsher tactics on suspected terrorists to find out information about upcoming attacks, the interrogators were not sure how to implement such tactics. Therefore, they began “mak[ing] it up on the fly,” the study finds. It continues, “Th[e] shortfall in advanced, research-based interrogation methods at a time of intense pressure from operational commanders to produce actionable intelligence from high-value targets may have contributed significantly to the unfortunate cases of abuse that have recently come to light.” [Congressional Quarterly, 4/4/2008]
The US State Department’s Rewards for Justice program launches an advertising campaign in dozens of airports in the US. The program distributes hundreds of wanted posters featuring al-Qaeda leaders such as Osama bin Laden. But strangely, the campaign is limited to the US and includes such airports as Londonderry, New Hampshire, and Myrtle Beach, South Carolina, which are not locations frequented by al-Qaeda leaders. Walter Deering, head of the Rewards for Justice program until 2003, will later point out that advertising in the wrong places can bog down investigators with false leads. “We’d get a lot of tips that were totally off the wall.” [Washington Post, 5/17/2008] Most al-Qaeda leaders are believed to be hiding in the tribal region of Pakistan near the Afghanistan border. But since at least the start of 2004, the Rewards for Justice program has been conducting little to no advertising in Pakistan (see January 2004).

[Source: AP / Tim Kupsick]Following the Democratic victory in the midterm elections, Richard Barlow, an intelligence analyst who was repeatedly fired for correctly saying Pakistan had a nuclear weapons program (see 1981-1982, August 1987-1988, and August 4, 1989), again applies for compensation. He was previously awarded compensation, but did not receive it (see 1999-2001). Although Barlow hopes to get his $80,000 pension back as well, he comments: “But this final hearing cannot indict any of those who hounded me, or misshaped the intelligence product. And it is too late to contain the flow of doomsday technology that Pakistan unleashed on the world.” [Guardian, 10/13/2007] The outcome of his application is not known as of February 2008.
Judge Reggie Walton releases a heavily redacted, 38-page document containing his November 15, 2006 opinion about the release of classified documents on behalf of the Libby defense team (see November 15, 2006 and November 22, 2006). Material pertaining to the classified documents themselves is redacted from the document. According to Walton’s ruling, Lewis Libby wants to use 129 classified documents to bolster his contention that his systemic and widespread memory failures led him to misinform investigators about his role in exposing CIA official Valerie Plame Wilson (see January 31, 2006). According to the Associated Press, if Walton decides to bar the use of some or all of those classified documents, Libby’s lawyers could then ask for a dismissal of the case. “If the case goes forward and the evidence is allowed,” the AP writes, “the trial could offer a behind-the-scenes look at the White House in the early months of the war in Iraq.” Walton has said he has tried to balance national security concerns with Libby’s right to a fair trial (see November 15, 2006 and November 22, 2006). He has said that pre-approving classified evidence “requires a court to play the role of Johnny Carson’s character Carnac the Magnificent by requiring it to render rulings before knowing the exact context of how those rulings will coincide with other evidence that has actually been developed at trial.” Special counsel Patrick Fitzgerald has characterized Libby’s threat to reveal classified information during the trial “graymail” (see After October 28, 2005, January 31, 2006, February 6, 2006, and (February 16, 2006)). Libby’s defense will argue that Libby was absorbed by several major national security areas of concern during the time Plame Wilson was exposed: threats from Islamist terror groups, working with Homeland Security to bolster US defenses, countering the nuclear threat posed by Pakistani scientist A.Q. Khan (see Late February 1999) and North Korea, the Iranian threat, developing security in Iraq after the fall of the Saddam Hussein regime, Israeli-Palestinian relations, incidents between Iraq and Turkey, and the unrest in Liberia as it threatened the safety of the US Embassy in Monrovia. [Source: Foreign Policy (.com)]Representative Nancy Pelosi (D-CA), slated to become the new speaker of the House when the Democrats take over leadership of the House in January 2007, names Silvestre Reyes (D-TX) as the chairman of the House Intelligence Committee. Reyes, a former soldier and Border Patrol chief before being elected to Congress, is named to the chairmanship over two other Intelligence Committee Democrats, Jane Harman (D-CA) and Alcee Hastings (D-FL), both of whom outrank him on the committee. Generally an advocate for the military, Reyes supports withdrawing from Iraq, and voted against the original war resolution. He has accused the Bush administration of using “cherry-picked” and “manipulated” intelligence to justify invading Iraq. He is also a strong critic of the Bush administration’s warrantless wiretapping program (see December 15, 2005). [Washington Post, 12/2/2006] Evidence will later show that Harman may have improperly accepted assistance from an Israeli agent, who promised to lobby Pelosi on Harman’s behalf for the chairmanship (see October 2005 and April 19, 2009).
