Deputy Attorney General James Comey sends a classified memo to Attorney General John Ashcroft. The contents of the memo are kept secret, but the American Civil Liberties Union (ACLU) will later learn that it is a briefing and summary of the Office of Legal Counsel (OLC)‘s preliminary conclusions regarding the Terrorist Surveillance Program (see March 2002). The Bush administration bows to growing pressure in the wake of former counterterrorism “tsar” Richard Clarke’s testimony before the 9/11 Commission (see March 21, 2004) and agrees to allow National Security Adviser Condoleezza Rice to testify before the Commission in public and under oath. It also agrees that President Bush and Vice President Dick Cheney can be interviewed in private by the whole Commission. However, according to the New York Times, “In exchange for her appearance, the [9/11 Commission] agreed not to seek testimony from other White House aides at public hearings, although it can continue to question them in private.” [New York Times, 3/31/2004] There was some debate in the administration over whether Rice would testify or not. As she is national security adviser and there are no allegations of criminal wrongdoing, there are good grounds for Rice refusing to testify under the doctrine of executive privilege, and this argument is made in particular by White House counsel Alberto Gonzales and David Addington, Vice President Cheney’s counsel. However, Rice insists that she wants to testify. According to author Philip Shenon, she is “uncharacteristically frantic” over the issue. White House chief of staff Andy Card will say, “Condi desperately wanted to do it.” Shenon will write of the decision, which is made by President Bush: “The political pressure on the White House was too great, and Rice’s persuasive powers with the president were more than a match for Alberto Gonzales’s. Rice was as strong-willed as any member of the White house staff. Gonzales was strong-willed until the president told him otherwise.” [Shenon, 2008, pp. 289-292] Author and media critic Frank Rich will later write: “The dirty little secret about the uproar over Clarke’s revelations were that many of them had been previously revealed by others, well before he published his book. But as the Bush administration knew better than anyone, perception was all, and perception began with images on television. Clarke had given the charges a human face.” The administration is sending Rice to testify publicly before the Commission, Rich will write, in part because she is the most telegenic of Bush’s top advisers, and has the best chance of “rebranding” the story with her face and testimony. The FBI issues a bulletin to state and local law enforcement agencies which states that terrorists may use cultural, artistic or athletic visas to slip into the United States undetected. This is followed by another bulletin one day later from the FBI and Department of Homeland Security warning of pending terrorist attacks on buses and trains in major cities during the summer. The uncorroborated intelligence cited by the warning indicates the possible use of a bomb made out of ammonium nitrate fertilizer and diesel fuel, similar to the one used in the Oklahoma City federal building attack. This intelligence, as well as the March 11, 2004, train bombings in Madrid (see 7:37-7:42 a.m., March 11, 2004), reportedly increases the level of concern that terrorists are planning an attack in the US. It is reported that the intelligence community believes that al-Qaeda has the full intent and capability to execute coordinated and deadly attacks on public transportation systems. [PBS, 4/2/2004] No such attacks occur. The warning apparently is given because a number of suspects are arrested in Britain who had been working on a fertilizer bomb, but they have been under surveillance and their fertilizer had been replaced with a harmless substance. In the thousands of hours of monitored conversations, none of them mentioned anything about bombing the US (see Early 2003-April 6, 2004). One day prior to the first alert, Charles Duelfer, the chief weapons inspector in Iraq, informed Congress that no WMD have been found to date. [MSNBC, 6/4/2007]

Vice President Dick Cheney travels to Asia to talk with US allies about dealing with North Korea’s nuclear program. Cheney reiterates the same position the US has had for years: the allies must join together in isolating North Korea and force “regime change” in that nation. The allies Cheney visits—South Korea, Japan, and China—have no interest in such a policy. They fear the possible consequences, be they a sudden onslaught of refugees, a power vacuum, or retaliatory strikes by Kim Jong Il in his last chaotic days in control of North Korea. Instead, China has opened up its own negotiations with North Korea, trying on its own to defuse the issue and calm Kim down. Meanwhile, North Korea says it has successfully solved all of the technical problems standing in the way of it producing nuclear weapons. No one knows precisely what, if any, nuclear weapons North Korea has, or what it is capable of producing (see January 10-22, 2004). [Washington Monthly, 5/2004]

In his monthly newsletter, conservative pundit Rush Limbaugh says that American liberals and Democrats are attacking President Bush for his Christian faith. “So now what does the left attack the president for?” he writes. “His belief in God!… Well, I’m going to predict something. If enough voters hear [Washington Post reporter] Bob Woodward berate Bush for relying on God, get ready for it.… Let them impugn the president of the United States for his admitting that he prays for the safety of the troops and the American people, let them make fun of that. They’re going to pay the price.” Limbaugh offers no evidence that nationally recognized liberals, Democratic Party members, or prominent reporters such as Woodward have criticized Bush for his Christian beliefs. Cover of Wilson’s ‘The Politics of Truth.’Cover of Wilson’s ‘The Politics of Truth.’ [Source: Barnes and Noble]Former ambassador Joseph Wilson, who helped disprove the White House’s claim that Iraq had attempted to buy uranium from Niger (see February 21, 2002-March 4, 2002 and July 6, 2003) and in turn had his wife, Valerie Plame Wilson, exposed as a CIA agent through a White House leak (see July 14, 2003, September 26, 2003, and September 30, 2003), publishes his book, The Politics of Truth: Inside the Lies that Led to War and Betrayed My Wife’s CIA Identity: A Diplomat’s Memoir. He had signed with a relatively small publisher, Carroll & Graf, after making a gentleman’s agreement with C&G editor Philip Turner, and refused to allow his literary agent to bid his book out for a larger advance in order to honor the agreement with Turner. According to Wilson’s wife, he worked relentlessly for four months to complete the book, eager to tell not just the story of his trip to Niger and his wife’s outing, but to write about his wide and varied diplomatic career in Africa and the Middle East (see September 5, 1988 and After, September 20, 1990, and Late November, 1990). [Wilson, 2007, pp. 171-172] The book sells well and garners mostly positive reviews; for example, author and former White House counsel John Dean gives it a glowing review in the New York Times (see May 12, 2004). But right-wing supporters of the Bush administration quickly publish their own vilifications of Wilson and his book (see July 12, 2004). Plame Wilson will write in 2007: “Having lived through the first spate of attacks on Joe’s credibility and character in the wake of the leak, I thought I had acquired some armor. I was wrong. I knew the comments were politically motivated, but they were still painful to read, and once again we felt under siege.” Plame Wilson is particularly alarmed by the death threats made against her and her family by unidentified telephone callers, including one “seriously deranged person” who manages to talk to her four-year-old son for a moment. She asks the CIA for additional security measures to protect her children, a request that the agency will eventually deny. She will recall: “To say that the CIA response ‘disappointed’ me doesn’t begin to touch the betrayal that I felt. After [REDACTED] loyal service, I expected the agency to come through on its standing promise to protect its ‘family,’ something that had always been a point of CIA pride.… Clearly, I was on my own.” [Wilson, 2007, pp. 178-180]

In November 2005, columnist Fareed Zakaria will write in Newsweek, “Ask any soldier in Iraq when the general population really turned against the United States and he will say, ‘Abu Ghraib.’ A few months before the scandal broke, Coalition Provisional Authority polls showed Iraqi support for the occupation at 63 percent. A month after Abu Ghraib, the number was 9 percent. Polls showed that 71 percent of Iraqis were surprised by the revelations. Most telling, 61 percent of Iraqis polled believed that no one would be punished for the torture at Abu Ghraib. Of the 29 percent who said they believed someone would be punished, 52 percent said that such punishment would extend only to ‘the little people.’” [Newsweek, 11/14/2005]

The Army issues a classified “Information Paper” entitled “Allegations of Detainee Abuse in Iraq and Afghanistan” that details the status of 62 investigations into prisoner abuse at Abu Ghraib and other sites in Iraq and Afghanistan. Cases documented in the paper include allegations of assaults, physical assaults, mock executions, sexual assaults, threatening to kill an Iraqi child to “send a message to other Iraqis,” stripping detainees, beating them and shocking them with a blasting device, throwing rocks at handcuffed Iraqi children, choking detainees with knots of their scarves, and interrogations at gunpoint. The document will be released to the public by the American Civil Liberties Union (ACLU) in 2006 (see May 2, 2006). Of the 62 cases, 26 involve detainee deaths. Some have already gone through courts-martial proceedings. The cases involve allegations from Abu Ghraib, Camp Cropper, Camp Bucca, and other sites in Mosul, Samarra, Baghdad, and Tikrit, and the Orgun-E facility in Afghanistan. Spc. Casey Sheehan.Spc. Casey Sheehan. [Source: Associated Press]Specialist Casey Sheehan, an Eagle Scout, church group leader, and honor student who enlisted in the Army in 2000, dies during an ambush in Sadr City, Baghdad. Sheehan had been in Iraq for only two weeks. His death will drive his mother, Cindy Sheehan, to become a noted peace activist (see August 6, 2005 and After). Specialist Sheehan and six other American soldiers die during a rescue mission in Sadr City. Sheehan and his compatriots are left to fend for themselves by their Iraqi cohorts, newly trained militiamen who flee when fighters for Moqtada al-Sadr’s Mahdi Army attack their position. Sheehan’s death will become a powerful counterargument against claims by Defense Secretary Donald Rumsfeld and other Bush officials that “over 200,000 Iraqis… have been trained and equipped” and are “out on the front line taking the brunt of the violence.” Author and media critic Frank Rich will write that given the wildly inflated claims by Rumsfeld and others about the size and effectiveness of the Iraqi soldiers, and the increasing power wielded by al-Sadr, “[i]t is hard to see what Cindy Sheehan’s young son had died for.” [US Department of Defense, 4/7/2004; Rich, 2006, pp. 193-194] Mrs. Sheehan, as part of a group of bereaved family members who suffered their own losses in Iraq, will meet with President Bush soon after her son’s death, and come away dissatisfied and angry. Recalling the meeting, she will say: “We wanted [the president] to look at pictures of Casey, we wanted him to hear stories about Casey, and he wouldn’t. He changed the subject every time we tried. He wouldn’t say Casey’s name, called him, ‘your loved one.’” [Los Angeles Times, 8/11/2005]

A 27-year-old Iraqi male dies during his interrogation by US Navy SEALs in Mosul. The American Civil Liberties Union (ACLU) will later find (see October 24, 2005) that during his confinement, “he was hooded, flex-cuffed, sleep deprived, and subjected to hot and cold environmental conditions, including the use of cold water on his body and hood.” The cause of death is officially “undetermined,” though the autopsy speculates that the prisoner may have died from hypothermia and/or related conditions. Notes from his interrogators say that he “struggled/ interrogated/ died sleeping.” [American Civil Liberties Union, 10/24/2005]

Condoleezza Rice sworn in before the 9/11 Commission.Condoleezza Rice sworn in before the 9/11 Commission. [Source: Larry Downing/ Reuters]National Security Adviser Condoleezza Rice testifies before the 9/11 Commission under oath and with the threat of perjury. The Bush administration originally opposed her appearance, but relented after great public demand (see March 30, 2004). [Independent, 4/3/2004] The testimony is a huge media event and major television networks interrupt their programming to carry it live. First, the Commission’s Democratic Vice Chairman Lee Hamilton reads a statement trying to establish a tone of non-confrontation and saying that the Commission’s purpose is “not to put any witness on the spot,” but “to understand and to inform.”
Rice Reads Lengthy Statement - Knowing that she has a deal to appear only once and for a limited time, Rice begins by reading a statement much longer than those read by other witnesses testifying before the Commission, a move specifically approved by Hamilton and the Commission’s chairman Tom Kean. [Shenon, 2008, pp. 293, 295] In the statement she repeats her claim that “almost all of the reports [before 9/11] focused on al-Qaeda activities outside the United States.… The information that was specific enough to be actionable referred to terrorists operation overseas.” Moreover, she stresses that the “kind of analysis about the use of airplanes as weapons actually was never briefed to us.” But she concedes: “In fact there were some reports done in ‘98 and ‘99. I think I was—I was certainly not aware of them.” [Washington Post, 4/8/2004]
Heated Questioning from Democrats - The exchanges with the Republican commissioners are polite, but Rice’s interactions with the Democrats on the Commission become heated. According to author Philip Shenon, her strategy is to “try to run out the clock—talk and talk and talk, giving them no chance to ask follow-up questions before the 10 minutes that each of the commissioners had been allotted had run out.” [Shenon, 2008, pp. 295] During questioning several subjects are discussed:
bullet Why didn’t counterterrorism “tsar” Richard Clarke brief President Bush on al-Qaeda before September 11? Clarke says he had wished to do so, but Rice states, “Clarke never asked me to brief the president on counterterrorism.”
bullet What was the content of the briefing President Bush received on August 6, 2001 (see August 6, 2001)? While Rice repeatedly underlines that it was “a historical memo… not threat reporting,” commissioners Richard Ben-Veniste and Tim Roemer ask her why it cannot therefore be declassified. [Washington Post, 4/8/2004] Asked what the PDB item’s still-secret title is, Rice gives it as “Bin Laden Determined to Attack inside the United States,” leading to an audible gasp from the audience. [Shenon, 2008, pp. 298] Two days later, the White House will finally publish it, and it will be shown to contain more than just historical information.
bullet Did Rice tell Bush of the existence of al-Qaeda cells in the US before August 6, 2001? Rice says that she does not remember whether she “discussed it with the president.”
bullet Were warnings properly passed on? Rice points out: “The FBI issued at least three nationwide warnings to federal, state, and law enforcement agencies, and specifically stated that although the vast majority of the information indicated overseas targets, attacks against the homeland could not be ruled out. The FBI tasked all 56 of its US field offices to increase surveillance of known suspected terrorists and to reach out to known informants who might have information on terrorist activities.” But commissioner Jamie Gorelick remarks: “We have no record of that. The Washington field office international terrorism people say they never heard about the threat, they never heard about the warnings.” [Washington Post, 4/8/2004]
bullet Under questioning from Democratic commissioner Bob Kerrey, she admits that she worked with Philip Zelikow, the Commission’s executive director, during the Bush administration transition, and that they discussed terrorism issues.
bullet She claims that a plan Clarke presented to her to roll back al-Qaeda in January 2001 (see January 25, 2001) was not actually a plan, but merely “a set of ideas and a paper” that had not been implemented. [Shenon, 2008, pp. 299-300]
Central Issues Unresolved - Rice does not apologize to the families of the victims of the 9/11 attacks, as Clarke did weeks earlier. The Associated Press comments, “The blizzard of words in Condoleezza Rice’s testimony Thursday did not resolve central points about what the government knew, should have known, did, and should have done before the September 11 terrorist attacks.” [Associated Press, 4/8/2004]
Testimony an 'Ambitious Feat of Jujitsu' - The Washington Post calls her testimony “an ambitious feat of jujitsu: On one hand, she made a case that ‘for more than 20 years, the terrorist threat gathered, and America’s response across several administrations of both parties was insufficient.’ At the same time, she argued that there was nothing in particular the Bush administration itself could have done differently that would have prevented the attacks of September 11, 2001—that there was no absence of vigor in the White House’s response to al-Qaeda during its first 233 days in office. The first thesis is undeniably true; the second both contradictory and implausible.” [Washington Post, 4/9/2004]
'Cherry-Picking' Rice's Testimony - In 2009, Lawrence Wilkerson, who is chief of staff for Secretary of State Colin Powell in 2004, will recall: “John [Bellinger, the legal adviser to the National Security Council] and I had to work on the 9/11 Commission testimony of Condi. Condi was not gonna do it, not gonna do it, not gonna do it, and then all of a sudden she realized she better do it. That was an appalling enterprise. We would cherry-pick things to make it look like the president had been actually concerned about al-Qaeda. We cherry-picked things to make it look as if the vice president and others, Secretary Rumsfeld and all, had been. They didn’t give a sh_t about al-Qaeda. They had priorities. The priorities were lower taxes, ballistic missiles, and the defense thereof.” [Vanity Fair, 2/2009]

President Bush talks about the Presidential Daily Briefing (PDB) he was given on August 6, 2001, entitled “Bin Laden Determined to Strike in US.” He claims, “There was nothing in this report to me that said, ‘Oh, by the way, we’ve got intelligence that says something is about to happen in America.‘… There was nothing in there that said, you know, ‘There is an imminent attack.’ That wasn’t what the report said. The report was kind of a history of Osama’s intentions.” [Associated Press, 4/12/2004] He adds, “[T]he PDB was no indication of a terrorist threat. There was not a time and place of an attack. It said Osama bin Laden had designs on America. Well, I knew that. What I wanted to know was, is there anything specifically going to take place in America that we needed to react to.… I was satisfied that some of the matters were being looked into. But that PDB said nothing about an attack on America. It talked about intentions, about somebody who hated America—well, we knew that.… Had I known there was going to be an attack on America, I would have moved mountains to stop the attack.” [US President, 4/19/2004] The complete text of the PDB was released the day before Bush’s comments and in fact the PDB does very clearly discuss an imminent attack on the US. For instance, it says that FBI information “indicates patterns of suspicious activity in this country consistent with preparations for hijackings or other types of attacks, including recent surveillance of federal buildings in New York.” And it discusses a call to a US “embassy in the UAE in May [2001] saying that a group of bin Laden supporters was in the US planning attacks with explosives” (see August 6, 2001).

In a news conference, President Bush is asked about the August 6, 2001 Presidential Daily Briefing (PDB) item entitled “Bin Laden Determined to Strike in US” (see August 6, 2001). Bush explains: “I asked for the briefing. And the reason I did is because there had been a lot of threat intelligence from overseas. And part of it had to do with the Genoa G8 conference that I was going to attend. And I asked at that point in time, let’s make sure we are paying attention here at home as well. And that’s what triggered the report.” [US President, 4/19/2004] Although Bush had shown some interest in counterterrorism around that time (see July 5, 2001 and June 20, 2001), the CIA analysts who drafted the PDB item will deny he asked for it specifically, saying they drafted it on the CIA’s initiative (see July 13, 2004). The main threat to the late July 2001 Genoa conference, as discussed in numerous articles even before the conference, was an al-Qaeda plot to fly an airplane into the conference building, killing Bush and other world leaders (see Mid-July 2001). But Bush’s tacit admission that a plot involving planes as weapons helped inspire the well-known August briefing passes without comment by the mainstream media. However, a professor will write a letter to the editor of Britain’s Financial Times noting Bush’s remark and commenting, “If President Bush had been sufficiently alarmed by the Italian defenses [against a suicide air attack] in Genoa to request a special report, he must have been able to recognize that, yes, it could happen in the US.” [Financial Times, 4/27/2004]

President Bush flounders in answering a question about what his “biggest mistake” after 9/11 might have been. During a White House press conference, Time reporter John Dickerson asks Bush: “In the last campaign, you were asked a question about the biggest mistake you’d made in your life, and you used to like to joke that it was trading Sammy Sosa. You’ve looked back before 9/11 for what mistakes might have been made. After 9/11, what would your biggest mistake be, would you say, and what lessons have you learned from it?” Bush’s press secretary, Scott McClellan, is horrified by what he later calls Bush’s “tortured response to a straightforward question.” Bush attempts to buy a moment with a quip—“I wish you would have given me this written question ahead of time, so I could plan for it”—but continues to fumble, saying: “John, I’m sure historians will look back and say, gosh, he could have done it better this way, or that way. You know, I just—I’m sure something will pop into my head here in the midst of this press conference, with all the pressure of trying to come up with an answer, but it hadn’t yet.”
'A Terrible Silence' - After what McClellan will recall as “an agonizingly long pause… a terrible silence [that] hung embarrassingly in the air,” Bush continues: “I would have gone into Afghanistan the way we went into Afghanistan. Even knowing what I know today about the stockpiles of weapons, I still would have called upon the world to deal with Saddam Hussein. See, I happen to believe that we’ll find out the truth on the weapons. That’s why we’ve sent up the independent commission. I look forward to hearing the truth, exactly where they are. They could still be there. They could be hidden, like the 50 tons of mustard gas in a turkey farm. One of the things that [weapons inspector] Charlie Duelfer talked about was that he was surprised at the level of intimidation he found amongst people who should know about weapons, and their fear of talking about them because they don’t want to be killed. There’s a terror still in the soul of some of the people in Iraq; they’re worried about getting killed, and, therefore, they’re not going to talk. But it will all settle out, John. We’ll find out the truth about the weapons at some point in time. However, the fact that he had the capacity to make them bothers me today, just like it would have bothered me then. He’s a dangerous man. He’s a man who actually—not only had weapons of mass destruction—the reason I can say that with certainty is because he used them. And I have no doubt in my mind that he would like to have inflicted harm, or paid people to inflict harm, or trained people to inflict harm on America, because he hated us.” After justifying his military actions, Bush concludes: “I hope I—I don’t want to sound like I’ve made no mistakes. I’m confident I have. I just haven’t—you just put me under the spot here, and maybe I’m not as quick on my feet as I should be in coming up with one.” McClellan will write that he remains “stone-faced and motionless” as Bush manages to flounder through the question without actually admitting any mistakes. 'Why Can't He Pull Up Some of Those Talking Points?' - McClellan’s first response is to blame himself for Bush’s inability to answer the question, then he has what he later calls a “counterreaction,” thinking: “Wait a second! We’re talking about the president of the United States here! He didn’t get to be president without being able to bat down a simple question. We’ve talked about mistakes. We’ve talked about 9/11. We’ve talked about the invasion of Iraq. Why can’t he pull up some of those talking points?” McClellan calls Bush’s answer “rambling, rather incoherent, and ultimately unsatisfying.”
A 'Cocksure' President - After the press conference, McClellan and White House communications director Dan Bartlett carefully approach the president. They agree among themselves that the Dickerson question had gone poorly, but know better than to broach the subject to Bush straight out. They begin, McClellan later recalls, by complimenting Bush on “hitting the right tone and getting his message across” on the government’s fight against terrorism. Then, McClellan will write: “Dan tactfully broached the awkward response of the Dickerson question. We had to bring it up in the little time we knew we could hold the president’s attention.” Bush says: “I kept thinking about what they wanted me to say—that it was a mistake to go into Iraq. And I’m not going to. It was the right decision.” McClellan will recall Bush’s tone as “cocksure and matter-of-fact, not testy.”
McClellan: Bush Unwilling to Admit Mistakes for Fear of Appearing Weak - McClellan will later reflect: “There were many other times, in private and in public, when the president defended the most fateful decision of his administration. But few will be remembered as vividly as the one he made that night. It became symbolic of a leader unable to acknowledge that he got it wrong, and unwilling to grow in office by learning from his mistake—too stubborn to change and grow.” McClellan believes Bush is afraid to admit a mistake for “fear of appearing weak,” and will write: “A more self-confident executive would be willing to acknowledge failure, to trust people’s ability to forgive those who seek redemption for mistakes and show a readiness for change.” McClellan will add that Bush was unwilling to risk “the personal pain he would have suffered if he’d had to acknowledge that the war against [Iraq] may have been unnecessary.” But, McClellan will conclude: “Bush was not one to look back once a decision was made. Rather than suffer any sense of guilt and anguish, Bush chose not to go down the road of self-doubt or take on the difficult task of honest evaluation and reassessment.” [McClellan, 2008, pp. 204-208]
Defending Bush - Representative Duncan Hunter (R-CA), chairman of the House Armed Services Committee, defends Bush’s refusal to admit any mistakes by saying Bush struck the proper tone with his questioners. “He was giving us a leadership statement on Iraq,” Hunter says, and adds, “That is not the right time for reporters to try to throw the president down on the analyst’s couch and have him try to tell them about all of his failings. Due to information leaked to the public about Ashcroft’s apparently poor performance and lack of interest in terrorism before the attacks (see Spring 2001, July 12, 2001, and September 10, 2001), in the words of author Philip Shenon, “Everybody expect[s] it to be a difficult day for Ashcroft—maybe the day that mark[s] the end of his tenure as George Bush’s attorney general.” Executing a strategy designed in advance by the Justice Department’s leadership, instead of defending his record, Ashcroft goes on the offensive against the Commission. First, Ashcroft withholds from the Commission a copy of his written statement, although all other witnesses provide this. Then, when his testimony starts, he blames the problems dealing with terrorist threats on information-sharing regulations set up by former Deputy Attorney General Jamie Gorelick, now a 9/11 commissioner. [Shenon, 2008, pp. 325-327]
Ashcroft Exaggerates Effect of Gorelick Memo - He comments: “The single greatest structural cause for September 11 was the ‘wall’ that segregated criminal investigators and intelligence agents. Government erected this ‘wall.’ Government buttressed this ‘wall.’ And before September 11, government was blinded by this ‘wall.’” The wall was a set of procedures that regulated the passage of information from FBI intelligence agents to FBI criminal agents and prosecutors to ensure that information obtained using warrants under the Foreign Intelligence Surveillance Act (FISA) would not be thrown out from criminal cases (see July 19, 1995). Ashcroft says that the wall impeded the investigation of Zacarias Moussaoui and that a “warrant was rejected because FBI officials feared breaching the ‘wall.’” (Note: two applications to search Moussaoui’s belongings were prepared. The first was not submitted because it was thought to be “shaky” (see August 21, 2001). The second warrant application was prepared as a part of an intelligence investigation under the Foreign Intelligence Surveillance Act, so it was not affected by the “wall” (see August 28, 2001)). According to Ashcroft, the wall also impeded the search for hijackers Khalid Almihdhar and Nawaf Alhazmi because criminal investigators were not allowed to join in. However, the 9/11 Commission will find that they could legally have helped, but were prevented from doing so by FBI headquarters (see August 29, 2001). Ashcroft asserts that 9/11 commissioner Jamie Gorelick was responsible for the wall. He cites a document he just declassified that had been written by Gorelick to deal with the two 1993 World Trade Center bombing cases (see March 4, 1995). That document becomes known as the “wall memo.” However, this memo only governed the two WTC cases; all other cases were governed by a different, but similar memo written by Attorney General Janet Reno a few months later (see July 19, 1995). Commission's Response - 9/11 Commission Chairman Thomas Kean and Vice Chairman Lee Hamilton will say that the “attorney general’s claim was overstated,” and that the two 1995 memos only codified a set of procedures that already existed (see Early 1980s). During questioning, Republican 9/11 commissioner Slade Gorton points out that Ashcroft’s deputy reaffirmed the procedures in an August 2001 memo that stated, “The 1995 procedures remain in effect today” (see August 6, 2001). [Kean and Hamilton, 2006, pp. 194-6] Ashcroft’s accusation against Gorelick produces an immediate public response. Commissioner Bob Kerrey (D-NE) will say: “Ashcroft was still speaking, and the e-mails were already coming in. The e-mails said things like, ‘You traitor, you should be ashamed of yourself for having somebody like Gorelick on the 9/11 Commission.’ I could see that this was a setup.” [Shenon, 2008, pp. 329]
Falsely Claims No Clinton Program to Kill Bin Laden - Ashcroft also claims there was no program to kill Osama bin Laden before 9/11, saying, “Let me be clear: my thorough review revealed no covert action program to kill bin Laden.” However, the 9/11 Commission has already found a memorandum of notification signed by President Clinton in 1998 after the African embassy bombings that allowed CIA assets to kill bin Laden, and two commissioners, Fred Fielding and Richard Ben-Veniste, point this out to Ashcroft. Attack Brings Commission Together - Paradoxically, the effect of Ashcroft’s attack is to bring the Commission—made up of five Democrats and five Republicans—together. Shenon will comment, “The Republicans were just as angry as the Democrats over what Ashcroft had done, maybe angrier.” Commissioner Slade Gorton (R-WA) will add, “There was universal outrage on the part of all 10 people.” [Shenon, 2008, pp. 332]

At this point, the commissioners realize “the controversy over Jamie Gorelick’s service on the commission was largely behind us.” That afternoon, the White House publicly expresses the president’s disappointment over the memos and the effort to discredit Gorelick loses momentum. The Times is the first newspaper to defy the Pentagon’s ban on such photos appearing in the news media. The photos were taken on April 7 by Tami Silicio, a contract cargo loader for Maytag Aircraft. The photos show caskets being loaded onto a transport plane in Kuwait. “The way everyone salutes with such emotion and intensity and respect,” she says in the Times article accompanying the photo. “The families would be proud to see their sons and daughters saluted like that.… So far this month, almost every night we send them home.… It’s tough. Very tough.” The photo publication provokes a round of criticism from White House officials, who claim the ban is to protect the sensibilities of the families of the fallen, as well as supportive statements from, among others, Democratic presidential candidate John Kerry.
Fired over Photos - Days later, both Silicio and her husband, David Landry, another contract worker for Maytag, are fired over the photo controversy. Concurrently, a Web site called the Memory Hole publishes over 300 such photos, obtained through a Freedom of Information Act request [Seattle Times, 4/18/2004; Deseret News, 4/30/2004; Rich, 2006, pp. 123] , and provoking more government protests (see April 14, 2004 and After). Many of the Memory Hole photographs were taken at Dover Air Force Base in Delaware. [Voice of America, 4/23/2007]
Silicio's Photographs to Honor War Dead, Not to Make Political Statement - Silicio’s friends describe her as not particularly involved in politics; Silicio herself says of one particularly stark photo she took: “The picture is about them, not me, about how they served their country, paid the price for our freedom, and the respect they receive on their way home from our military personnel at our air terminal.… I guess my feelings were so built up—my heart was so full of grief. And it came out in the picture.” Of the war, she says: “Our sons and daughters are over there now—and we need to support them. On the other hand, I think we should try to find a solution to the conflict other than killing each other.” [Seattle Times, 4/26/2004] She describes herself as feeling “like I was hit in the chest with a steel bar and got my wind knocked out” over being fired. “It wasn’t my intent to lose my job or become famous or anything,” she says. [Seattle Times, 4/22/2004]
'Don't Look' - Shortly after the photos are published, columnist Ellen Goodman writes: “We have shown images of concentration camps and killing fields. The media are full of violence. The recurring question—often unanswered—is how to show that war is hell without the hellishness. Is it wrong to be restrained? Is it invasive, exploitive or honest to show war as horrific? In such a context, how on earth can there be any doubt about showing a sanitized, symbolic array of 20 coffins in a plane or dozens in an aircraft hangar during a month when a hundred Americans are lost? Has our government flunked the confidence test? The disconnect between home front and war front is still enormous. This is a war that demands little sacrifice from civilians. Now those who have made what everyone knows is the ultimate sacrifice are coming home through Dover. And we are asked only one thing: Don’t look.” [Deseret News, 4/30/2004]

An Iraqi detainee named Awayed Wanas Jabar dies in US custody in Husaybah. Jabar has his legs tied to the bars of a window and a strap of engineer tape tied tightly around his midsection. According to the preliminary investigation into his death, “His position resembled that of a person who had been crucified.” One Marine later reports that Jabar seemed “exhausted, with his entire bodyweight appearing to be supported by the strap around his midsection.” He remains in that position for at least 90 minutes before the tape is cut. He dies 15 minutes later. No autopsy is conducted, so it is impossible to determine if he died from asphyxia or other causes. At a speech in Hershey, Pennsylvania, supporting the USA Patriot Act (see October 26, 2001), President Bush tells listeners that all US surveillance efforts are done with warrants from the Foreign Intelligence Surveillance Act (FISA) Court: “For years, law enforcement used so-called roving wire taps to investigate organized crime. You see, what that meant is if you got a wire tap by court order—and, by the way, everything you hear about requires court order, requires there to be permission from a FISA court, for example.… See, with court approval, we have long used roving wire taps to lock up monsters—mobsters. Now [with the Patriot Act in effect] we have a chance to lock up monsters, terrorist monsters.” [White House, 4/19/2004] The next day, Bush makes a similar claim during another pro-Patriot Act speech in Buffalo. He tells listeners: “[T]here are such things as roving wiretaps. Now, by the way, any time you hear the United States government talking about wiretap, it requires—a wiretap requires a court order. Nothing has changed, by the way. When we’re talking about chasing down terrorists, we’re talking about getting a court order before we do so. It’s important for our fellow citizens to understand, when you think Patriot Act, constitutional guarantees are in place when it comes to doing what is necessary to protect our homeland, because we value the Constitution. But a roving wiretap means—it was primarily used for drug lords. A guy, a pretty intelligence drug lord would have a phone, and in old days they could just get a tap on that phone. So guess what he’d do? He’d get him another phone, particularly with the advent of the cell phones. And so he’d start changing cell phones, which made it hard for our DEA types to listen, to run down these guys polluting our streets. And that changed, the law changed on—roving wiretaps were available for chasing down drug lords. They weren’t available for chasing down terrorists, see? And that didn’t make any sense in the post-9/11 era. If we couldn’t use a tool that we’re using against mobsters on terrorists, something needed to happen. The Patriot Act changed that. So with court order, law enforcement officials can now use what’s called roving wiretaps, which will prevent a terrorist from switching cell phones in order to get a message out to one of his buddies.” [White House, 4/20/2004] Former AT&T senior technician Mark Klein (see July 7, 2009 and May 2004), who helped install the equipment used by the National Security Agency (NSA) and his firm to intercept foreign and domestic Internet communications (see January 16, 2004), will later say that Bush’s insistence that the administration gets court orders before wiretapping communications is false. AT&T, on behalf of the NSA, was monitoring “billions of messages a second,” Klein will write, all without court orders. [Klein, 2009, pp. 47-48] Klein will call Bush’s description of the surveillance program “disingenuous,” and continue: “They present it as about phone calls. They’re just watching a few bad people who make phone calls to al-Qaeda and the Middle East, and you notice they don’t talk about the Internet hardly at all. That part of it hasn’t been revealed, because if they did, Americans would realize it’s not just a few people; it’s everybody, because the data they’re handing over is not selected out. When you run fiber optics through a splitter and you send all that data to a secret room, there’s no selecting going on there at all.… They have no way of sifting it out unless they look through it later. Now they can claim, ‘Oh, we are right as rain; we’re only doing the legal thing and selecting out a few people that we’re legally entitled to,’ but that’s only after they get all the data. The analogy I use: If the government claims: ‘Well, when you do your taxes, why don’t you just write me a blank check and we’ll fill in the amount? Don’t worry. We’ll do it legal. We’ll fill in the right amount,’ would you do that? Nobody would trust the government by writing a blank check to them. It’s the same thing with the data we’re giving them.… [T]he Fourth Amendment specifically bans general warrants. It calls for specific warrants in which the things to be seized and the persons to be seized are specifically named. There’s a reason for that. It’s to protect against arbitrary government power. And what they’ve done is to trample over the Fourth Amendment by basically instituting a general warrant on the Internet.” [PBS Frontline, 5/15/2007]

The Supreme Court hears oral arguments for and against the release of records pertaining to Vice President Cheney’s energy task force (the National Energy Policy Development Group—see May 16, 2001). The case is Cheney v. US District Court for the District of Columbia (03-0475) (see December 15, 2003). Two public interest groups, the environmentalist Sierra Club and the conservative government watchdog organization Judicial Watch, have joined to argue for the release of the records, saying that because the task force deliberations included energy industry executives and lobbyists, the task force is subject to the Federal Advisory Committee Act (FACA), which requires disclosure of the work of advisory groups that include non-federal employees. Bush administration lawyers, spearheaded by Solicitor General Theodore Olson, argue that releasing those records would violate the concept of “separation of powers.” The administration also argues that releasing the records, most pertinently the meetings between Cheney, his aides, and officials from energy corporations and lobbying firms, would damage the White House’s ability to receive candid advice. “This case is about the separation of powers and the president’s discretion to receive the opinions of subordinates,” Olson tells the court; Olson has resisted submitting task force documents even to the Court, saying that even that so-called “discovery” process would violate the Constitutional separation of powers. Lawyers for the Sierra Club and Judicial Watch argue that Cheney’s contacts with industry executives and lobbyists were improper while he was developing government policy that benefited their businesses. They are demanding to know whether energy lobbyists helped shape the government’s long-term energy policies. Lower courts agreed with Judicial Watch and the Sierra Club, and Cheney, with the Justice Department, has successfully ramrodded the case into the Supreme Court with unprecedented speed.
Justices Question Breadth of Requests - Justice Antonin Scalia, who refused to recuse himself from deliberations after accompanying Cheney on a duck-hunting trip in January, is one of the justices most favoring the government’s case. But even more moderate justices such as Stephen Breyer and Ruth Bader Ginsburg question whether the information request is too broad and inclusive. As for the White House, it argues that neither the courts nor Congress have any right to make any inquiries into the decisions of federal agencies and officials. Sierra Club lawyer David Bookbinder says the White House appears to have violated laws supporting open government: “What the panel said to energy executives was: Help us decide what the energy policy should be. A line has been crossed because the process should have been transparent. The panel was inordinately influenced by the energy industry.” Cheney has said that the executive branch must defend itself against the “continual encroachment by Congress.” The White House has already turned over some 40,000 documents from the task force after a lower court ruling compelled it to do so (see July 17, 2003), but the lawsuit before the Supreme Court says that another 100,000 potentially relevant documents and files remain secret. Cheney 'Beyond the Reach of the Law?' - In a legal analysis of the case, former Nixon White House counsel John Dean calls the case “extraordinary,” and notes that Cheney “contends that he is, in essence, beyond the reach of the law. It began as a set of rather pedestrian discovery matters in two consolidated civil lawsuits. Now, however, because of Cheney’s stance, it could be a landmark Constitutional decision.” Dean sees the case as an opportunity for Cheney, with the assistance of Olson and Scalia, “to expand executive powers.” [FindLaw, 3/26/2004]
Case Sent Back to Lower Court - The Court will vote to send the case back to the District of Columbia Appeals Court for further adjudication (see June 24, 2004). That court will rule in Cheney’s favor (see May 10, 2005).

Deputy Solicitor General Paul Clement appears before the Supreme Court to argue for the administration in Hamdi v. Rumsfeld (see June 28, 2004). Clement argues that the Court has no role in the White House’s decision to hold suspected terrorists designated as “enemy combatants” without trial or charge. During oral arguments, several of the justices ask Clement if the Bush administration considers itself bound by the Convention against Torture (see October 21, 1994). Clement replies, “The United States is signatory to conventions that prohibit torture and that sort of thing, and the United States is going to honor its treaty obligations.” He continues: “I wouldn’t want there to be any misunderstanding about this. It’s also the judgment of those involved in this process that the last thing you want to do is torture somebody or do something along those lines.” That evening, CBS’s 60 Minutes II airs the first photos of tortured prisoners at Abu Ghraib (see April 28, 2004). A Supreme Court Justice, during the oral arguments in the cases of Jose Padilla and Yaser Esam Hamdi, asks how the Court can be certain that government interrogators are not abusing detainees. Deputy Solicitor General Paul Clement answers that the court will have to “trust the executive to make the kind of quintessential military judgments that are involved in things like that.” [First, 6/2004 pdf file] The government’s legal strategy is so inflexible in part because of Vice President Cheney, who through his lawyer David Addington refuses to allow the Justice Department to budge from its intransigent position. For months, Solicitor General Theodore Olson and his deputy, Clement, have pled for modest shifts in policy that would bolster their arguments in court. Hamdi has languished in a Navy brig for two and a half years without a hearing or a lawyer. British citizen Shafiq Rasul has been held under similar conditions at Guantanamo for even longer (see November 28, 2001 and January 11, 2002-April 30, 2002). Olson says that Cheney’s position—the president has unlimited authority to order the indefinite detention of anyone suspected of terrorist activity without benefit of counsel or any judiciary intervention—would be easier to argue in court if he could “show them that you at least have some system of due process in place” to ensure against wrongful detention, according to a senior Justice Department official familiar with the issue. But Addington wins the argument, overriding Olson and the Justice Department by his arguments that any such retreat would restrict the freedom of future presidents and open the door to further lawsuits. The Supreme Court will find against Cheney in both the Hamdi (see June 28, 2004) and Rasul (see June 28, 2004) cases. Olson will resign as solicitor general 11 days later. Testifying Together, without Oaths or Recordings - The Commission permits Bush and Cheney, accompanied by White House counsel Alberto Gonzales, to appear together, in private, and not under oath. Author Philip Shenon will comment that most of the commissioners think this is an “obvious effort… to ensure that the accounts of Bush and Cheney did not differ on the events of 9/11.” [Shenon, 2008, pp. 342-343] Their testimony is not recorded. Questions Similar to Those Asked of Clinton - The Commission draws its questions from a previously-assembled list of questions for Bush and Cheney that Commission members have agreed to ask. According to commissioner Bob Kerrey: “It’s essentially the same set of questions that we asked President Clinton with one exception, which is just what happened on the day of September 11th. What was your strategy before, what was your strategy on September 11, and what allowed the FAA to be so surprised by a hijacking?” [Washington Post, 4/29/2004]
'Three Hours of Softballs' - After Bush starts the meeting with an apology for an attack by Attorney General John Ashcroft on commissioner Jamie Gorelick (see April 13-April 29, 2004), the Democratic commissioners are disarmed. Commissioner Slade Gorton will comment: “They knew exactly how to do this. They had us in the Oval Office, and they really pulled the talons and the teeth out of many of the Democratic questions. Several of my colleagues were not nearly as tough in the White House as they were when we went in that day.” Author Philip Shenon will call it “three hours of softballs.” Some of the toughest questions are asked by Republican John Lehman, who focuses on money allegedly passed by an acquaintance of the Saudi ambassador’s wife to two of the hijackers (see December 4, 1999). Lehman will say that Bush “dodged the questions.” [Shenon, 2008, pp. 343-345]
Cheney Says Little - Although the Commission’s Democrats are expecting Bush to defer to the vice president in his responses, reportedly Bush “thoroughly dominate[s] the interview.” Philip Zelikow, the Commission’s executive director, will later recall that Cheney only “spoke five percent of the time.” [Draper, 2007, pp. 292] According to four unnamed individuals that are in the room during the meeting, Cheney “barely spoke at all.” [Gellman, 2008, pp. 344] Gorelick will say: “There was no puppeteering by the vice president. He barely said anything.” [Shenon, 2008, pp. 344]
Early Departure - Two commissioners, Lee Hamilton and Bob Kerrey, leave the session early for other engagements. They will later say they had not expected the interview to last more than the previously agreed upon two-hour length. [Associated Press, 5/1/2004]

After the 35-minute segment, which Koppel titles “The Fallen,” he explains the rationale behind it. “Our goal tonight was to elevate the fallen above the politics and the daily journalism,” he says. “The reading tonight of those 721 names was neither intended to provoke opposition to the war nor was it meant as an endorsement. Some of you doubt that. You are convinced that I am opposed to the war. I am not, but that’s beside the point. I am opposed to sustaining the illusion that war can be waged by the sacrifice of the few without burdening the rest of us in any way.” [CNN, 5/1/2004]
Heavy Conservative Criticism - Author and media critic Frank Rich will call it “an unbelievably poignant roll call.” Others, mostly conservative pundits and lawmakers, disagree. Neoconservative pundit and editor William Kristol calls Koppel’s tribute a “stupid statement.” Fox News pundit Bill O’Reilly says the show might undermine morale if it tries to “exploit casualties in a time of war,” but fails to mention his own tribute to slain soldier Pat Tillman (see April 23, 2004 and April 29, 2004) the night before. [Rich, 2006, pp. 125] Brent Bozell, president of the conservative Media Research Center, criticizes what he calls the program’s “partisan nature,” and says its only goal is “to turn public opinion against the war.” [Associated Press, 5/1/2004]
Station Owners Order Broadcast Censored - The Sinclair Broadcast Group, a large regional consortium of local television stations whose executives are heavy donors to Republican campaigns, orders its eight ABC affiliates not to air Koppel’s broadcast. In its statement, Sinclair writes: “The action appears to be motivated by a political agenda designed to undermine the efforts of the United States in Iraq.… Mr. Koppel and Nightline are hiding behind this so-called tribute in an effort to highlight only one aspect of the war effort and in doing so to influence public opinion against the military action in Iraq.” The statement goes on to ask why ABC does not read the names of the thousands of Americans killed in the 9/11 attacks. Sinclair spokesman Mark Hyman says the broadcast is irrelevant: “Someone who died 13 months ago—why is that news? Those people did not die last week. It’s not an anniversary of the war, it’s not Memorial Day—so why this day? If this is Memorial Day, then go ahead and do it.” Hyman goes on to say of Koppel, “I think clearly here’s a guy who is opposed to the war and is trying to stir up public opposition to it,” and says that ABC is obviously trying to boost its ratings. Senator John McCain (R-AZ) calls the Sinclair decision “deeply offensive,” writing in a letter to Sinclair Broadcast Group president and CEO David Smith: “Your decision to deny your viewers an opportunity to be reminded of war’s terrible costs, in all their heartbreaking detail, is a gross disservice to the public, and to the men and women of the United States Armed Forces. It is, in short, sir, unpatriotic. I hope it meets with the public opprobrium it most certainly deserves.” Smith replies: “Our decision was based on a desire to stop the misuse of their sacrifice to support an anti-war position with which most, if not all, of these soldiers would not have agreed. While I don’t disagree that Americans need to understand the costs of war and sacrifices of our military volunteers, I firmly believe that responsible journalism requires that a discussion of these costs must necessarily be accompanied by a description of the benefits of military action and the events that precipitated that action.” [Greensboro News and Record, 4/30/2004; CNN, 5/1/2004; Jay Rosen, 5/1/2004; Associated Press, 5/1/2004; Rich, 2006, pp. 125] Jane Bright, who lost her son Sergeant Evan Ashcraft, writes in response: “The Sinclair Broadcast group is trying to undermine the lives of our soldiers killed in Iraq. By censoring Nightline they want to hide the toll the war on Iraq is having on thousands of soldiers and their families, like mine.” [Associated Press, 5/1/2004] Koppel says that any suggestion by Sinclair that he is “unpatriotic” or trying to “undermine the war effort” is “beneath contempt.” [CNN, 5/1/2004]
Media Watchdog Group Alleges Underlying Agenda - Robert McChesney of the media reform group Free Press says that Sinclair has an underlying motive in censoring the Nightline broadcast: “No one thinks for a second this decision has anything to do with journalism. It’s a politics-slash-business decision that Sinclair made because they don’t want to [anger] the White House.” Sinclair, a political supporter of the Bush administration, is trying to curry favor with the White House to bolster chances of gaining changes in station ownership rules, McChesney says. “The stench of corruption here is extraordinary.” [Associated Press, 5/1/2004]
Political Statement? - Koppel says he has no intention of making any sort of “political statement” by airing the segment. “I don’t want it to make a political statement. Quite the contrary,” he says. “My position on this is I truly believe that people will take away from this program the reflection of what they bring to it.… Why, in heaven’s name, should one not be able to look at the faces and hear the names and see the ages of those young people who are not coming back alive and feel somehow ennobled by the fact that they were willing to give up their lives for something that is in the national interest of all of us?” New York University journalism professor Jay Rosen disagrees. “Despite what he said about it,” Rosen writes, “Ted Koppel and Nightline were making a political statement last night by reading the names of ‘the fallen’ in Iraq. And there is nothing wrong with that—although it is risky because many will object.… By refusing to air the show… Sinclair Broadcasting, the country’s largest owner of television stations, was making a political statement right back.… Nothing intrinsically wrong with that, either, although it is risky and many will object.” ABC makes a political statement by choosing to air the segment, not only on the airwaves, but on the Jumbotron in New York City’s Times Square. Undermining Public Support of War? - Many pundits who argue against the Nightline memorium say that to air such a segment would undermine public support for the war, an argument which Rich later answers: “If the country was as firmly in support of this war as Bush loyalists claimed, by what logic would photographs of its selfless soldiers, either of their faces or their flag-draped coffins (see April 18, 2004 and After), undermine public opinion?” [Rich, 2006, pp. 125] Sue Niederer, who lost her son, Second Lieutenant Seth Dvorin, to a roadside bomb, says: “I feel it’s extremely important that the American people put a face and a name to the dead. When you just listen to a number, you don’t think about what may be behind that—that there’s a family, that there’s actually a person who has lost their life.” [CNN, 5/1/2004] Tim Holmes, who lost his son, Specialist Ernest Sutphin, says of Koppel’s broadcast: “That’s something I’d like to see. I feel like people have a right to see something like that—what’s going on over there.” Marine reservist Chief Warrant Officer David Dennis adds: “Let the American people know the Marines who have died, and everyone who has died. Former ambassador Joseph Wilson, in his newly published book The Politics of Truth, reflects on what he perceives as the absolute lack of need for the invasion and occupation of Iraq. He writes: “[J]ust what was required to ensure the [Hussein] regime’s eventual collapse was already happening before the middle of March 2003. We had infiltrated Saddam’s intelligence services; we had turned several of his senior military commanders. We were locked and loaded, but we did not need to fire. Not at all. A little patience would have achieved everything we wanted, without creating the whirlwind that we are now reaping in our bloody and chaotic occupation of the country.” While it has been trying on the nation’s patience to impose economic and military sanctions on Iraq for 12 years, Wilson notes, the Cold War lasted far longer and featured a much more dangerous opponent. How the US handled the Cold War provides “a useful blueprint on how to subvert an oppressive regime and achieve regime change without resorting to brute force,” he writes. April 30, 2004: Marines Withdraw from Fallujah

Military spokesman Brigadier General Mark Kimmitt explains that “this is not a withdrawal, this is not a retreat,” but his words are contradicted by a film clip, shown repeatedly on US news broadcasts, of an American tank literally going into reverse while pulling out of the city. The surviving citizens of Fallujah spill into the streets to celebrate the Americans’ withdrawal, dancing and singing. For many American citizens, the low point of the entire exercise may be when, immediately after the Marines’ departure, an Iraqi military officer bearing an uncanny resemblance to Saddam Hussein (even wearing a Republican Guard beret) is elevated to lead the Fallujah government by the Coalition Provisional Authority. The Pentagon claims to know nothing of the man’s identity, but it takes the media little time to learn that he had once been a high-ranking officer in Hussein’s Republican Guard and was close to the deposed dictator. Former ambassador Joseph Wilson gives an interview to the liberal news Web site Buzzflash about his newly published book, The Politics of Truth. In the interview and the book, Wilson notes that the invasion and occupation of Iraq have left many Iraqis with few choices advantageous to their American occupiers. As long as the US fails to provide reliable electricity, water, and security services for Iraqi citizens, Wilson writes, “they will see no option but to seek protection from within their traditional family and clan structures. We are fighting two wars in Iraq right now: the war against the insurgency and the war to restore public safety and services. General John Abizaid, head of US Central Command (Centcom) threatens Maj. Gen. Antonio M. Taguba over Taguba’s hard-hitting report on the Abu Ghraib prison abuses (see February 26, 2004). Riding with Abizaid in the back of a car in Kuwait a few weeks after Taguba’s report was leaked to the public, Taguba will later claim that Abizaid turned to him and quietly said, “You and your report will be investigated.” Taguba will later recall, “I wasn’t angry about what he said but disappointed that he would say that to me. A US intelligence analyst at Abu Ghraib tells military investigators that, as per a directive from Defense Secretary Rumsfeld (see December 2, 2002), it is “common that the detainees on [military intelligence] hold in [a facility known as the] hard site were initially kept naked and given clothing as an incentive to cooperate with us.” An interrogator tells the investigators that it is “common to see detainees in cells without clothes or naked,” and says it is “one of our approaches.” Enforced nudity is a violation of the Geneva Conventions. Coalition Joint Task Force-7, an Army command in Afghanistan, is still operating under rules of interrogation issued by CENTCOM commander General Ricardo Sanchez in September 2003 and rescinded in October 2003 (see October 12, 2003). This information comes from a report issued by Brigadier General Richard Formica (see November 2004) and from documents released by the American Civil Liberties Union (see July 10, 2006). The September 2003 rules allowed for the use of attack dogs, stress positions, sleep deprivation, and “environmental manipulation”—subjecting prisoners to extremes of heat and cold. In February 2004, a JTF-7 officer asked in a memo: “Can you verify that this [the September Sanchez memo] is a valid, signed policy? If not, can you send me (or steer me toward) the current policy?” The officer received a reply consisting of another copy of the September memo. On May 16, 2004, unit commanders become aware that the September memo had been superceded by reading news reports. [American Civil Liberties Union, 7/10/2006] According to the Defense Department, the September memo was “erroneously” provided to JTF-7. The Defense Department credits the Formica investigation for finding the error, which, Defense officials say, was “corrected immediately.… In the months between the policy’s creation and the investigation, some interrogations had been conducted using five unapproved interrogation methods, but none had resulted in abuse.” The official will note: “That’s the important point—we found [the error] and looked into it. Former ambassador Joseph Wilson, discussing his two trips to Niger in 1999 (see Fall 1999) and 2002 (see February 21, 2002-March 4, 2002) to investigate whether Iraq was attempting to obtain uranium from that nation, says that in 1999 he never discussed the subject of uranium purchases. Wilson, who met with former Nigerien Prime Minister Ibrahim Mayaki, says: “At that meeting, uranium was not discussed. It would be a tragedy to think that we went to war over a conversation in which uranium was not discussed because the Niger official was sufficiently sophisticated to think that perhaps he might have wanted to discuss uranium at some later date.” He will later tell Senate Intelligence Committee staffers that Mayaki was leery of discussing any trade issues at all because Iraq was under United Nations sanctions. Speaking about the Abu Ghraib scandal (see April 28, 2004), President Bush promises a “full investigation.” In an interview with Al Arabiya, he says: “It’s important for people to understand that in a democracy, there will be a full investigation. In other words, we want to know the truth. In our country, when there’s an allegation of abuse… there will be a full investigation, and justice will be delivered.… It’s very important for people and your listeners to understand that in our country, when an issue is brought to our attention on this magnitude, we act. And we act in a way in which leaders are willing to discuss it with the media.… In other words, people want to know the truth. That stands in contrast to dictatorships. A dictator wouldn’t be answering questions about this. A dictator wouldn’t be saying that the system will be investigated and the world will see the results of the investigation.” [White House, 5/5/2004] In April 2009, after significant revelations of Bush torture policies have hit the press (see April 16, 2009 and April 21, 2009), Atlantic columnist Andrew Sullivan will write: “Bush personally authorized every technique revealed at Abu Ghraib. He refused to act upon the International Committee of the Red Cross’s report that found that he had personally authorized the torture of prisoners, in violation of the Geneva Conventions and the UN Convention on Torture and domestic law against cruel and inhuman treatment. Maj. Gen. Antonio Taguba, author of a hard-hitting report on Abu Ghraib prison abuse, is summoned to meet Defense Secretary Donald Rumsfeld for the first time. Rumsfeld is scheduled to testify about Abu Ghraib before Congress the next day (see May 7, 2004). Also attending the meeting is Deputy Defense Secretary Paul Wolfowitz, Under-Secretary of Defense for Intelligence Stephen Cambone, Joint Chiefs of Staff Chairman Gen. Richard Myers, Army chief of staff Gen. Peter Schoomaker, Rumsfeld’s senior military assistant Lt. Gen. Bantz Craddock, and others. According to Taguba, when he walks in, Rumsfeld declares in a mocking voice, “Here… comes… that famous General Taguba—of the Taguba report!” Asked if there was torture at Abu Ghraib, Taguba recalls, “I described a naked detainee lying on the wet floor, handcuffed, with an interrogator shoving things up his rectum, and said, ‘That’s not abuse. That’s torture.’ There was quiet.” Rumsfeld asks who leaked Taguba’s report to the public, but Taguba says he doesn’t know. Rumsfeld then complains that he has not seen a copy of his report or the Abu Ghraib abuse photographs and yet he has to testify to Congress tomorrow. Taguba is incredulous, because he sent over a dozen copies of his report to the Pentagon and Central Command headquarters, and had just spent several weeks briefing senior military leaders about it. He also was aware that Rumsfeld, Myers, Craddock, and others were notified about the abuse and the photographs back in January, before Taguba even began his investigation (see January 15-20, 2004). Taguba will later suspect that the military leaders were trying to remain ignorant of the scandal to avoid responsibility and accountability. For instance, when Taguba urged one lieutenant general to look at the photographs, he got the reply, “[I] don’t want to get involved by looking, because what do you do with that information, once you know what they show?” Taguba will later complain of the meeting, “I thought they wanted to know. I assumed they wanted to know. I was ignorant of the setting.” [New Yorker, 6/17/2007]

The CIA’s inspector general completes a lengthy, secret report on the interrogation of detainees in US custody. The report, based on over 100 interviews, a review of the CIA’s videotapes of interrogations (see November 2005), and some 38,000 pages of documents, will remain secret throughout the Bush administration and into the first year of the Obama administration. Some portions will be made public over the years. The report includes evidence that US interrogators used harsh tactics—torture—against detainees who were not withholding information. Officials familiar with the report will say that it concludes some of the techniques used violate the UN Convention against Torture (see October 21, 1994). According to a declassified summary of the report later made public, the report finds that “it is difficult to determine conclusively whether interrogations have provided information critical to interdicting specific imminent attacks.” The threat of such an imminent attack was cited by the Justice Department in its numerous authorizations of torture. The report prompts CIA general counsel John Rizzo to request new statements from the Justice Department confirming the legality of CIA interrogation methods (see May 10, 2005 and May 30, 2005). Some time after Defense Secretary Donald Rumsfeld’s testimony to Congress, where he claimed he knew virtually nothing about the Abu Ghraib incidents (see May 7, 2004), former Defense Policy Board member Kenneth Adelman confronts Rumsfeld. As Adelman will recall: “I said to Rumsfeld, ‘Well, the way you handled Abu Ghraib I thought was abysmal.’ He says, ‘What do you mean?’ I say, ‘It broke in January of—what was that, ‘04? Yeah, ‘04. And you didn’t do jack sh_t till it was revealed in the spring.’ He says, ‘That’s totally unfair. I didn’t have the information.’ I said, ‘What information did you have? You had the information that we had done these—and there were photos. You knew about the photos, didn’t you?’ He says, ‘I didn’t see the photos. I couldn’t get those photos. A lot of stuff happens around here. I don’t follow every story.’ I say, ‘Excuse me, but I thought in one of the testimonies you said you told the president about Abu Ghraib in January. And if it was big enough to tell the president, wasn’t it big enough to do something about?’ He says, ‘Well, I couldn’t get the photos.’ I say, ‘You’re secretary of defense. Vice President Dick Cheney is interviewed in his office by federal prosecutors as part of the Valerie Plame Wilson identity leak investigation (see December 30, 2003). Cheney is asked if he knows who, if anyone, in the White House might have leaked Plame Wilson’s identity to the press. He is asked about conversations with his senior aides, including his chief of staff, Lewis “Scooter” Libby. He is also asked whether he knows of any concerted effort by White House officials to leak Plame Wilson’s identity. Cheney is not questioned under oath, and has not been asked to testify before the grand jury. He is represented by two lawyers, Terrence O’Donnell and Emmet Flood. Cheney Evades, Refuses to Answer Questions - In October 2009, an FBI interview summary regarding Cheney’s testimony will be released (see October 1, 2009). According to the document, Cheney equivocates or refuses to answer 72 times during his interview, either saying he cannot be certain about the information requested, or that he does not know.
Denies Informing Libby about Plame Wilson's CIA Status - One of the most fundamental questions Cheney is asked is about how Libby learned about Plame Wilson’s identity. Libby’s own notes indicate that he learned it from Cheney, and that he had shared his notes with Cheney in late 2003 (see Late September or Early October, 2003), in defiance of instructions from the FBI and the White House counsel’s office not to share information with colleagues (see September 29-30, 2003). But in his testimony, Cheney “cannot recall Scooter Libby telling him how he first heard of Valerie Wilson. It is possible Libby may have learned about Valerie Wilson’s employment from the vice president… but the vice president has no specific recollection of such a conversation.” [Federal Bureau of Investigation, 5/8/2004 pdf file; Associated Press, 11/2/2009] Cheney testifies that contrary to the evidence, he learned of Plame Wilson’s CIA status from Libby, who informed him that a number of reporters had contacted Libby in July 2003 to say that Plame Wilson had been responsible for arranging her husband’s trip to Niger to investigate the Niger uranium claims. Cheney says that the next time he heard about Plame Wilson and her connection to her husband was when he read Robert Novak’s article outing her as a CIA officer (see July 14, 2003). Cheney is lying; he informed Libby of Plame Wilson’s identity (see (June 12, 2003)).
Denies Knowledge of Wilson Trip to Niger - He also denies knowing that Plame Wilson’s husband, war critic and former ambassador Joseph Wilson, was sent to Niger to investigate claims that Iraq was attempting to buy uranium from that country (see (February 13, 2002) and February 21, 2002-March 4, 2002), and says the CIA never briefed him about Wilson’s trip (see March 5, 2002). Future testimony will challenge Cheney’s claims, as witnesses will testify that Cheney, Libby, Deputy National Security Adviser Stephen Hadley, the Defense Department, the State Department, the Defense Intelligence Agency, the Joint Chiefs of Staff, the National Security Council, and President Bush were all given copies of a CIA cable sent to Cheney’s office that debunked the Niger claims (see December 2001, Shortly after February 12, 2002, March 5, 2002, February 12, 2002, March 8, 2002, October 15, 2002, Mid-October 2002, October 18, 2002, January 2003, and March 8, 2003). Refuses to Answer about WMD NIE - Prosecutor Patrick Fitzgerald, leading the interview, presses Cheney to discuss evidence that shows he pressured Bush to quickly declassify portions of the October 2002 National Intelligence Estimate on Iraqi WMD (see October 1, 2002) for the purpose of making the case for invading Iraq. Libby provided selected NIE information to New York Times reporter Judith Miller while simultaneously leaking Plame Wilson’s identity to her (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003) and other reporters. Cheney refuses to confirm that he discussed anything regarding the NIE with Bush, saying that he could not comment on any private or privileged conversations he may have had with the president. Libby has already testified to the declassification of the NIE, telling prosecutors that he talked to Miller following the “president’s approval relayed to me through the vice president.”
Insists Plame Wilson's Identity Never Used to Discredit Husband - Cheney insists that no one in the White House ever talked about leaking Plame Wilson’s CIA status to the press in an attempt to discredit her husband. There was never any discussion, Cheney says, of “pushing back” on Wilson’s credibility by raising the issue of nepotism, the fact that his wife worked for the CIA, the same agency that dispatched him to Niger to run down the report of an agreement to supply uranium to Iraq. In his own testimony, Libby was far less emphatic, saying “[i]t’s possible” he may have discussed the idea with Cheney. Both men lie in their testimony (see March 9, 2003 and After, May 2003, June 3, 2003, June 9, 2003, June 11 or 12, 2003, (June 11, 2003), 12:00 p.m. June 11, 2003, 2:00 p.m. June 11, 2003, 5:27 p.m. June 11, 2003, (June 12, 2003), June 19 or 20, 2003, July 7, 2003 or Shortly After, July 7-8, 2003, 12:00 p.m. July 7, 2003, July 8, 2003, and 7:35 a.m. July 8, 2003). The father, Jimmy Boyle, says in the ad: “On September 11, terrorists murdered nearly 3,000 Americans, including 346 firefighters, one of which was my son, Michael. I lost my son. I spoke to him that day. He went to work that morning, and he had died for a reason: because somebody hates America. And that day, George Bush became a leader, a war president.” CU is spending $100,000 to run the ad for a week in Ohio, Pennsylvania, West Virginia, Wisconsin, and Washington, DC. Author and former Nixon White House counsel John Dean reviews former ambassador Joseph Wilson’s new book, The Politics of Truth (see April 2004). Dean, who has long been a fierce critic of the Bush administration, uses the review to examine aspects of the controversy surrounding the White House’s disproven claim that Iraq attempted to buy uranium from Niger (see February 21, 2002-March 4, 2002 and July 6, 2003) and the outing of Wilson’s wife as a CIA agent through a White House leak (see June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, Before July 14, 2003, and July 14, 2003). Dean calls the book “riveting and all-engaging… provid[ing] context to yesterday’s headlines, and perhaps tomorrow’s, about the Iraq war and about our politics of personal destruction,” as well as detailed information about Wilson’s long diplomatic service in Africa and the Middle East, and what Dean calls “a behind-the-scenes blow-by-blow of the run-up to the 1991 Persian Gulf war.”
'Anti-Dumb-War' - Dean also admires Wilson’s opposition to the Iraq war, saying that “Wilson is not antiwar. Rather, he is ‘anti-dumb-war’” and noting that while Wilson is not himself particularly conservative (or liberal), he considers the neoconservatives who make up the driving force in President Bush’s war cabinet “right-wing nuts.”
'Vicious Hatchet Job' - Dean quickly moves into the White House-orchestrated attempt to besmirch Wilson’s credibility, calling it “the most vicious hatchet job inside the Beltway since my colleague in Richard Nixon’s White House, the dirty trickster Charles W. Colson, copped a plea for defaming Daniel Ellsberg and his lawyer (see June 1974).… It was an obvious effort to discredit Wilson’s [Niger] report, and, Wilson believes, a you-hurt-us-we-will-hurt-you warning to others.” While Wilson writes with passion and anger about the outing of his wife, he restrains himself from giving too many personal details about her, relying instead on material already revealed in press interviews and reports. Dean notes that Wilson believes his wife’s name was leaked to the press by any or all of the following White House officials: Lewis “Scooter” Libby, the chief of staff to Vice President Dick Cheney; Karl Rove, Bush’s chief political strategist; and Elliott Abrams, a national security adviser and former Iran-Contra figure (see October 7, 1991). Though Dean is correct in noting that Wilson comes to his conclusions “based largely on hearsay from the Washington rumor mill,” he will be proven accurate in two out of three of his assertions (see July 8, 2003, 11:00 a.m. July 11, 2003, June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). General Peter Pace, vice chairman of the Joint Chiefs of Staff, admits that interrogation techniques used by US guards and interrogators in Baghdad’s Abu Ghraib prison violated the Geneva Conventions. Pace says he is not sure who approved those techniques. Pace, who a week before had blamed lower-ranking soldiers for carrying out the abuses (see May 5, 2004), contradicts Defense Secretary Donald Rumsfeld, who has insisted that the techniques used on prisoners at Abu Ghraib meet international standards for humane treatment. In a hearing conducted by the Senate Armed Services Committee, Jack Reed (D-RI) asks Pace what he would think if he saw a US Marine in enemy custody, bound, naked, and forced into a painful position with a hood over his head. Would it violate the Geneva standards? Reed asks. “I would describe it as a violation, sir,” Pace replies. Reed notes that just that sort of treatment had previously been authorized by Lieutenant General Ricardo Sanchez, commander of US ground forces in Iraq. Pace says he knows of no military guidelines that would allow prisoners to be put in so-called “stress positions,” denied sleep, threatened with dogs, or kept in isolation for weeks on end. Committee Democrats contend with the committee chairman, John Warner (R-VA), who initially attempts to stop discussion of the Abu Ghraib torture allegations and focus only on the issue of the Bush administration’s new request for $25 million in funding for the military actions in Iraq and Afghanistan. Warner eventually gives way to the Democrats after Ted Kennedy (D-MA) says: “I’ve been in the Senate 42 years, and I have never been denied the opportunity to question any person that’s come before a committee, on what I wanted to ask for it. And I resent it and reject it on a matter of national importance.” The New York Times notes, “Outrage over the prison abuse has been near-universal, but in recent days Republicans have been quicker than Democrats to try to change the subject or insist on limiting release of the new prison photos.” House Majority Leader Tom DeLay (R-TX) says that “[s]ome people are overreacting” to the prison photos and surrounding revelations of abuse. “The people who are against the war are using this to their political ends.” [New York Times, 5/13/2004]

The New York Times learns that FBI Director Robert Mueller has ordered FBI interrogators to stay out of CIA-led interrogations of suspected al-Qaeda members. Mueller, and many FBI officials, believe the CIA’s interrogation tactics are too brutal and violate domestic and international laws. Mueller and other FBI officials have objected to the use of techniques such as waterboarding, as well as forced starvation, forced drugging, and beatings. FBI officials told Mueller that the techniques would be prohibited in criminal cases. Some CIA officers are worried that public outrage over the recent revelations of prisoner abuse at Baghdad’s Abu Ghraib prison might lead to a closer examination of the agency’s treatment of al-Qaeda prisoners. “Some people involved in this have been concerned for quite a while that eventually there would be a new president, or the mood in the country would change, and they would be held accountable,” one says. “Now that’s happening faster than anybody expected.” [BBC, 5/13/2004] In 2008, a Justice Department investigation (see May 20, 2008) will reveal that sometime in mid-2002, the FBI’s then-assistant director for counterterrorism, Pasquale D’Amuro, ordered FBI agents at Guantanamo to stop participating in interrogations and leave the facility. D’Amuro brought the issue to Mueller’s attention; according to the Justice Department report, D’Amuro “stated that his exact words to Mueller were ‘we don’t do that’ and that someday the FBI would be called to testify and he wanted to be able to say that the FBI did not participate in this type of activity.” D’Amuro was concerned that the use of such aggressive interrogation techniques “failed to take into account an ‘end game.’” The report will continue: “D’Amuro stated that even a military tribunal would require some standard for admissibility of evidence. Obtaining information by way of ‘aggressive’ techniques would not only jeopardize the government’s ability to use the information against the detainees, but also might have a negative impact on the agents’ ability to testify in future proceedings.” Mueller agreed with D’Amuro and issued what became a “bright line rule” barring FBI agents from participating in CIA and military interrogations involving such methods. In a talk given at UCLA’s Center for International Relations, retired General Anthony Zinni, the former commander of the US military’s Central Command (CENTCOM - see April 17, 2003 and After and January 2003), discusses his early planning for the overthrow of Iraq’s Saddam Hussein and the inevitable chaos that would ensue, in plans called “Desert Crossing” (see April-July 1999). Zinni began working on the plans shortly after 1998’s “Desert Fox” bombing campaign (see December 16-19, 1998).
Plans to Overthrow, No Plans to Reconstruct - He recalls: “[I]t struck me then that we had a plan to defeat Saddam’s army, but we didn’t have a plan to rebuild Iraq. And so I asked the different agencies of government to come together to talk about reconstruction planning for Iraq.… I thought we ought to look at political reconstruction, economic reconstruction, security reconstruction, humanitarian need, services, and infrastructure development. We met in Washington, DC. We called the plan, and we gamed it out in the scenario, Desert Crossing.”
Many of Subsequent Problems Envisioned - Zinni says that he and his team envisioned many of the problems encountered after the March 2003 invasion and subsequent toppling of the Iraqi government: “The first meeting surfaced all the problems that have exactly happened now. This was 1999. And when I took it back and looked at it, I said, we need a plan. Not all of this is a military responsibility. I went back to State Department, to the Office of Foreign Disaster Assistance, Department of Commerce, and others and said, all right, how about you guys taking part of the plan. We need a plan in addition to the war plan for the reconstruction. Not interested. Would not look at it.” Zinni, he recalls, decided to have the plans created himself, “because I was convinced nobody in Washington was going to plan for it, and we, the military, would get stuck with it.”
Zinni Plans Ignored by Bush Planners - Before the invasion, he recalls, he recommended that the military planners go back and look at his plans: “When it looked like we were going in [to Iraq], I called back down to CENTCOM and said, ‘You need to dust off Desert Crossing.’ They said, ‘What’s that? Never heard of it.’ So in a matter of just a few years it was gone. The corporate memory. And in addition I was told, ‘We’ve been told not to do any of the planning. It would all be done in the Pentagon.’” Zinni’s original plans called for a civilian occupation authority with offices in all 18 Iraqi provinces; the current Coalition Provisional Authority only has one set of offices, in Baghdad’s Green Zone. And Zinni’s plans called for around 400,000 troops, instead of the 160,000 Defense Secretary Donald Rumsfeld approved. [John Prados, 11/4/2006]

Radio host Glenn Beck, whose conservative talk show is aired by syndicated program provider Clear Channel, rails against Michael Berg, whose son Nick Berg was recently executed by militant Iraqis (see March 24-May 11, 2004). Beck, like his fellow radio conservatives Sean Hannity and Michael Savage, has aired the audio of Berg’s execution on his show in recent days. After his son’s death, Michael Berg criticized the Bush administration’s handling of the war in Iraq; for doing so, Beck calls him “despicable” and “a scumbag.” On his show, Beck directs a question at Berg: “Can you let your son’s body become the same temperature as your son’s head before you turn this into a political campaign against the president—could you do that?” Beck says he would say the same about Michael Berg if he were “a Republican and a supporter of the war and rah-rah George W. Bush and whatever.” He says he refuses to “fake” any sympathy for Berg because of Berg’s criticism of President Bush and the war effort. “I find this guy despicable,” he says. “Everything in me says that. The ‘want to be a better person today than I was yesterday’ says he’s a dad, he’s grieving, but I don’t buy that. I’m sorry, I don’t buy it. Sam Francis, a white supremacist and syndicated columnist (see September 1995), marks the 50th anniversary of the landmark civil rights case Brown v. Board of Education by calling it “the most dangerous and destructive Supreme Court decision in American history.” Francis blames the decision for giving the Supreme Court the impetus to “gut… state and local law enforcement powers” (referring to the 1966 Miranda v. Arizona ruling that gave suspects basic rights after being arrested), “ban… school prayer,” weaken laws “against sedition and obscenity,” overturn death penalty statutes and “laws governing sexual morals,” and legalize abortion. “This is merely a partial list of the tyranny the Court has succeeded in creating because the American people allowed it to get away with Brown,” he writes. The decision is uniformly disastrous, he continues, with no “merits in law” to justify its existence. The Constitution never intended for children of different races to go to school together, Francis writes, and therefore the Supreme Court should never have ruled that schools should be desegregated. Moreover, he writes, school segregation actually promotes the academic success of African-American children. “By cramming through a legally groundless ruling that authorized the federal engineering of American society, Brown alienated Southern whites for at least a generation, wrecked public education, and helped revolutionize both cities and suburbs,” he concludes. “Today, schools once entirely white because of segregation laws are entirely black because of Brown. The white middle class exodus has meant the domination of cities by a black underclass, the crooks and demagogues it puts in office, and the financial and social devastation of American urban life.” Francis’s columns are provided to a national audience by Creators Syndicate. On May 17, 2004, security officials say that recent intelligence has led to increased concern about the possibility of a major terrorist attack in the US. It is believed that the attack could take place as early as the summer and before November, perhaps in an attempt to affect the outcome of the Presidential election. Potential targets include the dedication of the National World War II Memorial on the National Mall in Washington, the G8 economic summit on Sea Island, Georgia, Fourth of July celebrations, the Democratic convention in Boston, the Republican convention in New York, and the Olympics in Greece. However, no specific target, time or date is identified for the possible attack. Sources do state that the assessment is new and is the result of intelligence gathered over time. However, an official with the Department of Homeland Security, speaking on condition of anonymity, states that “We are not aware of any new highly credible intelligence indicating a planned attack in the US this summer. Nothing in the current intelligence is exceptionally specific.” [CNN, 5/25/2004] The next day, Attorney General John Ashcroft and FBI Director Robert Mueller hold a news conference to warn of a “plane attack inside the United States.” They warn that terrorists are “poised for an immediate attack.” Ashcroft says “credible intelligence from multiple sources indicates that al-Qaeda plans to attempt an attack on the United States in the next few months. This disturbing intelligence indicates al-Qaeda’s specific intention to hit the United States hard.” [CNN, 5/26/2004] The Justice Department asks for assistance in locating seven alleged terrorist operatives and states an increased concern about attacks over the summer. [CBS News, 6/14/2004] It is later revealed the threat actually came from a group that falsely claimed responsibility for the terror attacks in Madrid. One expert says that the group is “not really taken seriously by Western intelligence.” These warnings come as the administration is under heavy criticism for failures in Iraq. The Abu Ghraib torture scandal dominates headlines. [Rolling Stone, 9/21/2006 pdf file] This warning also comes on the heels of other bad news for the Bush administration. During a May 16 interview on Meet the Press, Secretary of State Colin Powell is cut off by an aide while discussing misleading CIA information regarding WMD in Iraq. He admits that “it turned out that the sourcing was inaccurate and wrong and in some cases, deliberately misleading. And for that, I am disappointed and I regret it.” [MSNBC, 6/15/2004] Three days later, Newsweek reports that White House counsel Alberto Gonzalez warned in a January 25, 2002 internal White House memo that US officials could be prosecuted for war crimes due to the unprecedented and unusual methods used by the Bush administration in the war on terrorism. The memo will remain classified, but the American Civil Liberties Union (ACLU) will learn that it pertains to the so-called “McCain Amendment,” later known as the Detainee Treatment Act (see December 15, 2005). President Bush will sign the bill into law, but will include a signing statement that states the administration will not follow the law because it impinges on the president’s constitutional authority to conduct military operations (see December 30, 2005). Conservative radio host Michael Savage marks the 50th anniversary of the historic civil rights case Brown v. Board of Education by saying, “Everything about [the case] is sickening.” Savage criticizes President Bush for “trying to outmaneuver [Democratic presidential candidate John] Kerry on the race issue” by being photographed “hugging people of color” at a church in Birmingham, Alabama. Savage calls the idea that there is racism in America “left-wing brainwashing.… [W]hat, racism still exists? Well okay, where does it still exist? Can you tell me of some minority here who can’t get ahead in this country if he’s smart, or she’s smart, and she pushes, as much as a white person?… In fact they’re given priority treatment everywhere, you know that.” Savage calls a recent claim by Kerry that schools remain underfunded and divided by income “rubbish, pure rubbish,” and implies that African-American children will perform at lower levels than their white counterparts no matter how equal funding is: “I can show you one minority school after another, with more funding per capita than surrounding, suburban white schools, and the kids still do badly. The General Accounting Office (GAO) finds that the Bush administration broke two federal laws as part of its publicity campaign to promote its new Medicare prescription drug policies. The Department of Health and Human Services (HHS) illegally spent federal monies on what amounts to covert propaganda in producing and distributing “video news releases,” or VNRs, to local television news broadcasters around the country that were designed to look like objective news reports (see March 15, 2004). The GAO findings do not carry legal weight, because the GAO acts as an adviser to Congress. The viewers in the more than 40 cities who saw the reports did not know they were watching government-produced videos anchored by public relations “flacks” paid by HHS who were not real reporters. The VNRs have only fueled criticism of the Medicare prescription drug coverage program, which gives private health care firms and prescription drug companies a much larger role in providing and setting prices for Medicare recipients’ prescriptions. Democrats have long insisted that the law cripples Medicare beneficiaries’ ability to receive low-cost prescriptions in favor of funneling Medicare dollars into the pharmaceutical companies’ coffers; with the GAO findings, Democrats now say that the government used illegal propaganda tactics to “sell” the citizenry on the new program. The administration has already admitted that the program will cost hundreds of billions of dollars more than originally claimed. Democratic presidential candidate John Kerry (D-MA) calls the videos “another example of how this White House has misrepresented its Medicare plan.” Kerry’s Senate colleague, Edward Kennedy (D-MA), says: “The new GAO opinion is yet another indictment of the deception and dishonesty that has become business as usual for the Bush administration. It was bad enough to conceal the cost of the Medicare drug bill from the Congress and the American people. It is worse to use Medicare funds for illegal propaganda to try to turn this lemon of a bill into lemonade for the Bush campaign.” The Bush administration continues to insist that the VNR program is legal. “GAO opinions are not binding on the executive branch. That’s an opinion of the GAO. We don’t agree,” says HHS spokesman Bill Pierce, who justifies the VNR usage by pointing to their ubiquitous usage in corporate settings. Asked if he understands that a viewer might be angry at being led to believe that the VNRs were real news stories, Pierce replies, “If I’m a viewer, I’d be angry at my television station.” [Washington Post, 5/20/2004; Los Angeles Times, 5/20/2004]

A Defense Intelligence Agency (DIA) document shows that Lieutenant General Ricardo Sanchez, the supreme commanding officer of US forces in Iraq, approved of extreme interrogation methods to be used by military interrogators against detainees. A DIA officer in charge of a team of interrogators states that there is a 35-page order spelling out the rules of engagement that interrogators are supposed to follow, and that they are encouraged to “go to the outer limits to get information from the detainees by people who wanted the information.” When asked to whom the officer is referring, the officer answers, “LTG Sanchez.” The officer states that the expectation coming from “headquarters” is to break the detainees. [Source: CBS News]Retired Marine General Anthony Zinni was the chief of the US Central Command until 2000, and, until just before the invasion of Iraq, the Bush administration’s special envoy to the Middle East. Now he has become an outspoken critic of the administration’s war efforts in Iraq. Zinni gives an interview to CBS’s 60 Minutes, in part to promote his new biography, Battle Ready, co-authored by famed war novelist Tom Clancy.
'Dereliction of Duty' among Senior Pentagon Officials - Zinni says that senior officials at the Pentagon, from Defense Secretary Donald Rumsfeld on down, are guilty of what he calls dereliction of duty, and he believes it is time for “heads to roll.” Zinni tells correspondent Steve Kroft: “There has been poor strategic thinking in this. There has been poor operational planning and execution on the ground. And to think that we are going to ‘stay the course,’ the course is headed over Niagara Falls. I think it’s time to change course a little bit, or at least hold somebody responsible for putting you on this course. Because it’s been a failure.” In his book, Zinni writes: “In the lead up to the Iraq war and its later conduct, I saw at a minimum, true dereliction, negligence, and irresponsibility, at worse, lying, incompetence, and corruption.… I think there was dereliction in insufficient forces being put on the ground and fully understanding the military dimensions of the plan. I think there was dereliction in lack of planning.”
'The Wrong War at the Wrong Time' - Zinni calls Iraq “the wrong war at the wrong time,” and with the wrong strategy. Before the invasion, Zinni told Congress (see October 31, 2002): “This is, in my view, the worst time to take this on. And I don’t feel it needs to be done now.” The generals never wanted this war, Zinni says, but the civilians in the Pentagon and the White House did. “I can’t speak for all generals, certainly,” he says. “But I know we felt that this situation was contained (see Summer 2002-2003). Saddam was effectively contained.… And I think most of the generals felt, let’s deal with this one at a time. Let’s deal with this threat from terrorism, from al-Qaeda.”
Much Larger Force Required - Zinni was heavily involved in planning for any invasion of Iraq, going back to at least 1999 (see April-July 1999). Zinni always envisioned any such invasion as being implemented with enough ground forces to get the job done quickly and cleanly. Rumsfeld had different ideas—the invasion could be carried off with fewer troops and more high-tech weaponry. Zinni wanted around 300,000 troops: “We were much in line with General Shinseki’s view. We were talking about, you know, 300,000, in that neighborhood.” Would a larger force have made a difference? Kroft asks. Zinni replies, “I think it’s critical in the aftermath, if you’re gonna go to resolve a conflict through the use of force, and then to rebuild the country.” Rumsfeld should have anticipated the level and ferocity of violence that erupted in the aftermath of the toppling of the Hussein government, but, Zinni says, he did not, and worse, he ignored or belittled those such as Shinseki and a number of foreign allies who warned him of the possible consequences. Instead, Zinni notes, Rumsfeld relied on, among other sources, fabricated intelligence from Ahmed Chalabi and his Iraqi National Congress (see September 19-20, 2001).
'Seat of the Pants Operation' - The entire reconstruction effort was, in Zinni’s mind, a seat-of-the-pants affair. “As best I could see, I saw a pickup team, very small, insufficient in the Pentagon with no detailed plans that walked onto the battlefield after the major fighting stopped and tried to work it out in the huddle,” he says, “in effect to create a seat-of-the-pants operation on reconstructing a country.” Coalition Provisional Authority head L. Paul Bremer is “a great American who’s serving his country, I think, with all the kind of sacrifice and spirit you could expect. But he has made mistake after mistake after mistake.” Bremer’s mistakes include “Disbanding the army (see May 23, 2003). De-Baathifying (see May 16, 2003), down to a level where we removed people that were competent and didn’t have blood on their hands that you needed in the aftermath of reconstruction—alienating certain elements of that society.” Zinni reserves most of the blame for the Pentagon: “I blame the civilian leadership of the Pentagon directly.”
Heads Should Roll, Beginning with Rumsfeld's - Zinni continues: “But regardless of whose responsibility I think it is, somebody has screwed up. And at this level and at this stage, it should be evident to everybody that they’ve screwed up. And whose heads are rolling on this? That’s what bothers me most.” The first one to go, Zinni says, is Rumsfeld: “Well, it starts with at the top. If you’re the secretary of defense and you’re responsible for that.”
Neoconservatives at Fault - Next up are Rumsfeld’s advisers, whom Kroft identifies as the cadre of neoconservatives “who saw the invasion of Iraq as a way to stabilize American interests in the region and strengthen the position of Israel.” Zinni says: “Certainly those in your ranks that foisted this strategy on us that is flawed. Certainly they ought to be gone and replaced.” Kroft identifies that group as including Deputy Defense Secretary Paul Wolfowitz; Undersecretary of Defense Douglas Feith; former Defense Policy Board member Richard Perle; National Security Council member Elliott Abrams; and Vice President Cheney’s chief of staff, Lewis “Scooter” Libby. Zinni calls them political ideologues who have hijacked US policy in Iraq: “I think it’s the worst-kept secret in Washington. That everybody—everybody I talk to in Washington has known and fully knows what their agenda was and what they were trying to do.” Like so many others who criticized them, Zinni recalls, he was targeted for personal counterattacks. After publishing one article, he says: “I was called anti-Semitic. I mean, you know, unbelievable that that’s the kind of personal attacks that are run when you criticize a strategy and those who propose it.”
Fundamental Conceptual Flaws - Zinni says the neoconservatives believed they could remake the Middle East through the use of American military might, beginning with Iraq. Instead, the US is viewed in the region as “the modern crusaders, as the modern colonial power in this part of the world.”
Changing Course - Zinni has a number of recommendations. He advises President Bush and his senior officials to reach out much more strongly to the United Nations, and to US allies, and secure the UN’s backing. Do these other countries “want a say in political reconstruction? Do they want a piece of the pie economically? If that’s the cost, fine. What they’re gonna pay for up front is boots on the ground and involvement in sharing the burden.” Many more troops are needed on the ground, and not just American troops, he says, enough to seal off the borders, protect the road networks.
Exit Strategy - Zinni says that planning for an exit is necessary because it is inevitable that the US will want to withdraw, and that time will come sooner rather than later. “There is a limit,” he says. “I think it’s important to understand what the limit is. Now do I think we are there yet?”
Speaking Out - He is speaking out, he says, because it is his duty to do so: “It is part of your duty. Look, there is one statement that bothers me more than anything else. And that’s the idea that when the troops are in combat, everybody has to shut up. Imagine if we put troops in combat with a faulty rifle, and that rifle was malfunctioning, and troops were dying as a result. I can’t think anyone would allow that to happen, that would not speak up. Well, what’s the difference between a faulty plan and strategy that’s getting just as many troops killed?” [CBS News, 5/21/2004]

Vincent Cannistraro, the former head of the CIA’s counterterrorism office, says that no evidence has ever been found to support a tie between Iraq and the 9/11 attacks. Nor has any evidence shown that any connections exist between Iraq and the 1993 World Trade Center bombing (see February 26, 1993). Instead, those ties were postulated for purposes of political manipulation. Cannistraro says: “The policymakers already had conceits they had adopted without reference to current intelligence estimates. And those conceits were: Saddam was evil, a bad man, he had evil intentions, and they were greatly influenced by neoconservative beliefs that Saddam had been involved with the sponsorship of terrorism in the United States since as early as 1993, with the first World Trade Center bombing.… None of this is true, of course, but these were their conceits, and they continue in large measure to be the conceits of a lot of people like Jim Woolsey” (see February 2001). The intelligence and law enforcement communities have a different view: “The FBI did a pretty thorough investigation of the first World Trade Center bombing,” Cannistraro says, “and while it’s true that their policy was to treat terrorism as a law-enforcement problem, nevertheless, they understood how the first World Trade Center bombing was supported… and had linkages back to Osama bin Laden. He was of course, not indicted… because the FBI until recently believed that you prosecuted perpetrators, not the sponsors. In any event they knew there was no Saddam linkage. Laurie Mylroie promoted a lot of this (see Late July or Early August 2001), and people who came in [to the Bush administration], particularly in the Defense Department—[Paul] Wolfowitz and [Douglas] Feith (see June 2001)—were acolytes, promoting her book, The Study of Revenge (see October 2000), particularly in the Office of Special Plans (see September 2002), and the Secretary’s Policy Office (see Shortly After September 11, 2001). In any event, they already had their preconceived notions.… So the intelligence, and I can speak directly to the CIA part of it, the intelligence community’s assessments were never considered adequate.” [Middle East Policy Council, 6/2004]

Former Defense Intelligence Agency analyst Patrick Lang writes that, in his opinion, a “small group of people who think they are the ‘bearers’ of a uniquely correct view of the world… sought to dominate the foreign policy of the United States in the Bush 43 administration, and succeeded in doing so through a practice of excluding all who disagreed with them. Those they could not drive from government they bullied and undermined until they, too, had drunk from the vat.” (Lang correlates the phrase “drunk from the vat” with the common metaphor of “drinking the Kool-Aid,” a particularly nasty turn of phrase sourced from the 1978 Jonestown massacre in Guyana. The phrase now means, Lang explains, “that the person in question has given up personal integrity and has succumbed to the prevailing group-think that typifies policymaking today.”) The result is the war in Iraq, Lang argues, with steadily rising body counts and no clear end in sight.
'Walking Dead' Waiting for Retirement - Lang notes that senior military officers have said that the war’s senior strategist, General Tommy Franks, “had drunk the Kool-Aid,” and many intelligence officers have told Lang that “they too drank the Kool-Aid and as a result consider themselves to be among the ‘walking dead,’ waiting only for retirement and praying for an early release that will allow them to go away and try to forget their dishonor and the damage they have done to the intelligence services and therefore to the republic.” Lang writes that the US intelligence community has been deeply corrupted, bent on serving “specific group goals, ends, and beliefs held to the point of religious faith” and no longer fulfilling its core mission of “describing reality. The policy staffs and politicals in the government have the task of creating a new reality, more to their taste.… Without objective facts, decisions are based on subjective drivel. Wars result from such drivel. We are in the midst of one at present.”
Shutting out Regional Experts - There is little place in Bush administration policy discussions for real experts on the Middle East, Lang writes: “The Pentagon civilian bureaucracy of the Bush administration, dominated by an inner circle of think-tankers, lawyers, and former Senate staffers, virtually hung out a sign, ‘Arabic Speakers Need Not Apply.’ They effectively purged the process of Americans who might have inadvertently developed sympathies for the people of the region. Instead of including such veterans in the planning process, the Bush team opted for amateurs brought in from outside the executive branch who tended to share the views of many of President Bush’s earliest foreign policy advisors and mentors. Because of this hiring bias, the American people got a Middle East planning process dominated by ‘insider’ discourse among longtime colleagues and old friends who ate, drank, talked, worked, and planned only with each other. Most of these people already shared attitudes and concepts of how the Middle East should be handled. Their continued association only reinforced their common beliefs.” The Bush administration does not countenance dissent or open exchange and discussion of opposing beliefs. The Bush policymakers behave, Lang writes, as if they have seized power in a ‘silent coup,’ treating outsiders as political enemies and refusing to hear anything except discussion of their own narrow, mutually shared beliefs.
Using INC Information - Beginning in January 2001, the Bush administration began relying heavily on dubious intelligence provided by Ahmed Chalabi and his Iraqi National Congress (INC—see January 30, 2001). The INC began receiving State Department funds in what some White House officials called the “Information Collection Program.” While the US intelligence community had little use for Chalabi, considering him an unreliable fabricator (see 1992-1996), he had close ties with many in the administration, particularly in the office of the vice president and in the senior civilian leadership of the Pentagon (see 1960s, 1985, and 1990-1991). Lang writes that while the INC excelled in providing Iraqi defectors with lurid, usually false tales, “what the program really did was to provide a steady stream of raw information useful in challenging the collective wisdom of the intelligence community where the ‘War with Iraq’ enthusiasts disagreed with the intelligence agencies.” The office of the vice president created what Lang calls “its own intelligence office, buried in the recesses of the Pentagon, to ‘stovepipe’ raw data to the White House, to make the case for war on the basis of the testimony of self-interested emigres and exiles” (see August 2002). From working as the DIA’s senior officer for the Middle East during the 1991 Gulf War and after, Lang knows from personal experience that many neoconservative White House officials believe, as does Vice President Cheney, that it was a mistake for the US to have refrained from occupying Baghdad and toppling Saddam Hussein in 1991 (see August 1992). Lang calls some of these officials “deeply embittered” and ready to rectify what they perceive as a grave error. [Middle East Policy Council, 6/2004]

The Bush administration, pressured by increasingly harsh condemnations from the presidential campaign of Democrat John Kerry, grudgingly agrees to consider opening bilateral talks with North Korea over that country’s restarted nuclear program. Previously, the US had been one of six nations involved in such negotiations, which have gone nowhere in large part due to US intransigence (see August 2003). The Bush administration has also insisted on the importance of Chinese involvement in the talks, which serves to raise China’s profile in the region and lower the US’s. Bush officials offer North Korea a deal in which that nation would provide an accounting of all its nuclear facilities; in return the US would broker a resumption of fuel oil shipments to the North by South Korea, Japan, China, and Russia, and would consider drafting security assurances (see December 12, 2003) and lifting economic sanctions. Greg Thielmann, a former director of the Strategic, Proliferation, and Military Affairs Office at the State Department’s intelligence bureau, compares the aluminum tubes allegations (see Between April 2001 and September 2002 and September 8, 2002) to the Iraq-Niger uranium allegations (see Between Late 2000 and September 11, 2001 and 9:01 pm January 28, 2003), and finds the aluminum tubes allegations an “even more egregrious case of policymakers’ contamination of the intelligence process than the” Iraq-Niger uranium allegations, in the words of former Defense Intelligence Agency official Patrick Lang. Lang goes on to quote Thielmann as saying: “What was done with the aluminum tubes was far worse than what was done with the uranium from Africa. Because the intelligence community had debated over a period of months, and involved key scientists and engineers in the national laboratories—and foreigners as well—in a long and detailed discussion. The way I would have characterized it, if you had asked me in July 2002, when I turned over the leadership of my office, there was a growing consensus in the intelligence community that this kind of aluminum was not suitable for the nuclear weapons program. So I was really quite shocked to see—I was just retired—the National Intelligence Estimate say that the majority of agencies came to the opposite interpretation, that it was going into the nuclear weapons program.” Anyone in the White House or the National Security Council should have, in Lang’s words, “seen through the subterfuge and drawn the proper conclusion.” Again, Lang quotes Thielmann: “If they had read the NIE [National Intelligence Estimate—see October 1, 2002] in October, it is transparent that there were different views in the intelligence community. They could have read, for example, that the Department of Energy and the State Department INR [intelligence bureau] believed that the aluminum tubes were not going into the nuclear weapons program and instead were going into conventional artillery rockets. And, if one assumes a modicum of intelligence understanding at the [National Security Council], they should know that the agency that is most able to judge on this would be the Department of Energy. They control all the laboratories that actually over the years have enriched uranium and built centrifuges.” [Middle East Policy Council, 6/2004]

Maj. Gen. Antonio M. Taguba is a young officer rising through the ranks of the US Army with unusual speed. But after his hard-hitting report on the Abu Ghraib abuses (see February 26, 2004), he claims that Gen. John Abizaid, head of US Central Command, threatens to have him investigated (see May 2004). Taguba had been scheduled to rotate to the Third Army’s headquarters in Georgia in June of 2004, but instead he is ordered to work at the Pentagon. A retired four-star Army general later tells Taguba that he had been sent to the job in the Pentagon so that he could “be watched.” Taguba later claims that in January of 2006, General Richard Cody, the Army’s Vice-Chief of Staff. calls him and bluntly tells him without any explanation, “I need you to retire by January of 2007.” Taguba does retire in January 2007, after thirty-four years of active service.. He will later complain, “They always shoot the messenger. To be accused of being overzealous and disloyal—that cuts deep into me. Philip Zelikow, the executive director of the 9/11 Commission, finally accepts the fact that he cannot successfully spin or browbeat the commission staff into reporting links between Iraq and al-Qaeda as factual (see July 12, 2004). His most recent efforts to rewrite a report claiming such links was thwarted by angry commission staffers (see January 2004), and for months he has dodged charges that he is a White House “plant,” there to ensure the commission makes the kind of conclusions that Bush officials want it to make. Now, he finally admits that there is no evidence to support the claim of a connection between Iraq and al-Qaeda, although there was some minor contact. Author Philip Shenon will later write: “The intelligence showed that when bin Laden wanted to do business with Iraq, Iraq did not want to do business with al-Qaeda…. Saddam Hussein saw [Osama] bin Laden… as a threat to his own very brutal and very secular rule in Iraq.” The widely reported story about 9/11 hijacker Mohamed Atta meeting an Iraqi spy in Prague (see April 8, 2001 and September 14, 2001) has been examined and re-examined, and found to be unsupported (see December 2001). Zelikow is forced to admit the reality of the situation. Shenon will write: “Even if he wanted to, there was little Zelikow could do to rescue the administration now…. If Zelikow tried to tamper with the report now, he knew he risked a public insurrection by the staff, with only a month before the commission’s final report was due.” Bush officials are horrified at the prospect of the commission reporting flatly that there are no verifiable links of any kind between al-Qaeda and Iraq. Since the failure of the US to find WMDs in Iraq, the Bush administration has shifted its rationale for invading that nation—now it was a punitive measure against one of the backers of the 9/11 attacks, and senior Bush officials, most notably Vice President Cheney, have been advocating that point for over a year. Citing personal reasons, CIA Director George Tenet announces he will be stepping down in the next month. President Bush praises Tenet’s service, but there is widespread agreement that significant intelligence failures occurred during his tenure, most strikingly 9/11 itself. Sources also suggest that Tenet, originally a Clinton appointee, has been made a convenient scapegoat for Bush administration intelligence failures in Iraq and elsewhere. [CNN, 6/4/2004; Independent, 6/4/2004] Tenet and the Bush administration are expecting harsh criticism from several reports expected to find serious failures in intelligence gathering and analysis related to the 9/11 attacks. Most damaging is an upcoming Senate Intelligence Committee report expected to single out the CIA for errors in its judgments before the Iraq war (see June-November 2004). Committee chairman Pat Roberts (R-KS) has warned the administration that the report will be so harsh that questions will be raised as to whether senior CIA officials should be held accountable. Tenet will be replaced by Deputy Director John McLaughlin until a replacement is named, and will eventually be replaced by Porter Goss (see September 24, 2004). A friend of Tenet’s, former Deputy Director Richard Kerr, says that Tenet “may have believed that he was hurting the president. He’s an honorable person, and he may have had that as a consideration.” Former Democratic senator David Boren, a close friend and mentor of Tenet’s, says Tenet is not leaving because of criticisms likely to be leveled at either him or the agency: “If criticism either actual or anticipated was a factor, he would have left a long time ago. It’s been months of his desiring to leave.” Bush has asked Tenet to remain in the job several times over the past few months. When Tenet told Bush of his intentions to leave on June 2, Bush asked him to stay through the end of the year. Tenet replied that summer is a natural break point and a good time for him to depart. All the camaraderie and mutual praise between the two men aside, many believe that Tenet is departing in part because he is seen as a possible political liability for Bush. Senator Richard Shelby (R-AL) says, “I don’t think there are any tears over there” in the White House over Tenet’s departure. Former Senator Bob Graham (D-FL) believes that Tenet was in some way pushed to leave. “This president has been enamored of George Tenet, and has been reluctant to hold him or anyone else accountable, and that failure was becoming a bigger and bigger liability,” he says. According to Graham, Bush announces Tenet’s resignation for his own political well-being, “under circumstances where he is at the crime scene as short as possible.” Apparently, senior White House officials such as Vice President Dick Cheney and Secretary of State Colin Powell learn of Tenet’s resignation just a few moments before it is announced to the press. Two Congressmen who knew last night of the resignation were Goss (R-FL) and John Warner (R-VA), the chairmen of the House Intelligence and Senate Armed Services Committees, respectively. CNN announces that conservative pundit Dinesh D’Souza is a new political analyst for the network. D’Souza became active in conservative politics and punditry as an editor of the Dartmouth Review in the early 1980s, where he authored and published numerous inflammatory articles reviling, among others, blacks, Jews, and gays (see 1981, March 15, 1982, October 1982, and 1983). From Dartmouth, D’Souza went to the White House, where he served as a senior domestic policy analyst in the Reagan administration. He has served as a fellow at the American Enterprise Institute and the Hoover Institution, and published a number of books, including 1995’s inflammatory The End of Racism, which progressive media watchdog organization Media Matters described as advancing the idea that “low-income black people are basically ‘pathological’ and that white racism really isn’t racism at all, just a logical response to this ‘pathology.’” D’Souza’s Web site “argues that the American obsession with race is fueled by a civil rights establishment that has a vested interest in perpetuating black dependency”; in a 1995 Wall Street Journal op-ed, he argued that “[t]he best way for African-Americans to save private sector affirmative action may be to repeal the Civil Rights Act of 1964.” Two African-American conservatives, Glenn Loury and Robert Woodson, resigned from AEI after the publication of The End of Racism and another racially objectionable book, The Bell Curve, by AEI fellow Charles Murray. A Pew Center for the People and the Press study finds that 35 percent of Republicans consistently watch Fox News, while 21 percent of Democrats do so. Fox has experienced the largest increase in viewers, and 52 percent of its audience defines itself as conservative. In general, Republicans consider Fox the most reliable broadcast news outlet, while Democrats consider it the least reliable. Overall, trust in mainstream news outlets, from CNN and ABC to the Wall Street Journal and the New York Times, has declined sharply since 2000. The Washington Post reveals the existence of a secret August 2002 memo from the Justice Department. This memo advised the White House that torturing al-Qaeda terrorists in captivity “may be justified,” and that international laws against torture “may be unconstitutional if applied to interrogations” conducted in the US war on terrorism (see August 1, 2002). The legal reasoning was later used in a March 2003 report by Pentagon lawyers assessing interrogation rules governing the military detention center at Guantanamo Bay (see March 6, 2003). Bush officials say that despite the memo, it has abided by the Geneva Conventions and other international treaties proscribing torture (see February 7, 2002). The incidents at Abu Ghraib, where numerous Iraqi prisoners were tortured, maimed, and sometimes murdered, were not policy, officials say. Human rights organizations and civil libertarians are appalled at the memo. “It is by leaps and bounds the worst thing I’ve seen since this whole Abu Ghraib scandal broke,” says Tom Malinowski of Human Rights Watch. “It appears that what they were contemplating was the commission of war crimes and looking for ways to avoid legal accountability. The effect is to throw out years of military doctrine and standards on interrogations.” A senior Pentagon official says that the Judge Advocate Generals (JAGs) were quick to challenge the Justice Department opinion when it was promoted by the Pentagon. “Every flag JAG lodged complaints,” the official says. A senior military attorney says of the memo: “It’s really unprecedented. For almost 30 years we’ve taught the Geneva Convention one way. Once you start telling people it’s okay to break the law, there’s no telling where they might stop.” [Washington Post, 6/8/2004] Attorney General John Ashcroft tells the Senate Judiciary Committee that he will not discuss the contents of the August 2002 memo, nor turn it over to the committee. “I believe it is essential to the operation of the executive branch that the president has the opportunity to get information from the attorney general that is confidential,” he says. During the annual G-8 economic summit, held in Sea Island, Georgia [2004 G8 Summit, 2004] , President Bush rejects the notion that he approved the use of torture. “The authorization I gave,” the president says, “was that all we did should be in accordance with American law and consistent with our international treaty obligations. That’s the message I gave our people.” He adds, “What I authorized was that we stay within the framework of American law.” And to emphasize his point, he says: “Listen, I’ll say it one more time.… The instructions that were given were to comply with the law. That should reassure you. We are a nation of laws. We follow the law. We have laws on our books. You could go look at those laws and that should reassure you.” [US President, 6/21/2004] During the summit, the foreign ministers of the participating countries are suddenly called to Washington to meet with Bush and Secretary of State Colin Powell. As Canadian Foreign Minister Bill Graham will later recall: “Colin suddenly phoned us all up and said, ‘We’re going to the White House this morning.’ Now, this is curious, because normally the heads of government don’t give a damn about foreign ministers. We all popped in a bus and went over and were cordially received by Colin and President Bush. The president sat down to explain that, you know, this terrible news had come out about Abu Ghraib and how disgusting it was. The thrust of his presentation was that this was a terrible aberration; it was un-American conduct. This was not American. [German Foreign Minister] Joschka Fischer was one of the people that said, ‘Mr. President, if the atmosphere at the top is such that it encourages or allows people to believe that they can behave this way, this is going to be a consequence.’ The president’s reaction was: ‘This is un-American. Americans don’t do this. People will realize Americans don’t do this.’ The problem for the United States, and indeed for the free world, is that because of this—Guantanamo, and the ‘torture memos’ from the White House (see November 6-10, 2001 and August 1, 2002), which we were unaware of at that time—people around the world don’t believe that anymore. His first target is not the Commission itself, but the media, particularly the New York Times, which has just published a front-page article entitled “Panel Finds No Qaeda-Iraq Tie.” Cheney’s first appearance is on CNBC’s Capital Report. Correspondent Gloria Borger notes, “I don’t think I’ve ever seen you… as exercised about something as you seem today.” Cheney leads off by calling the Times reporting “outrageous,” and accuses the newspaper of manufacturing a division between the administration’s claims of a “Qaeda-Iraq tie” and the Commission’s report that no such ties ever existed. “There’s no conflict,” he says. He asserts that “[W]e don’t know” if Iraq was involved in 9/11 and adds that no one has “been able to confirm” or “knock… down” the claim that 9/11 plotter Mohamed Atta met with an Iraqi intelligence agent in Prague in April of 2001. Reporters who doubt the connection are “lazy,” he says. When Borger notes that Commission investigators have found no evidence to support that allegation, Cheney asserts that he “probably” knows information the 9/11 Commission does not. Several 9/11 Commission members, including chairman Thomas Kean and vice-chairman Lee Hamilton, are alarmed at Vice President Dick Cheney’s response to the commission’s claim that no link exists between Iraq and al-Qaeda (see June 17, 2004). They have no desire to go toe-to-toe with an enraged White House over the question. Hamilton privately asks Doug MacEachin, the principal author of that portion of the report, to go back and sift the evidence again to ensure that he missed nothing that might bear out the White House’s arguments. Publicly, Kean and Hamilton are much more resolute. If Cheney has information that he has not shared with the commission, as Cheney has implied, he needs to turn it over promptly. “I would like to see the evidence that Mr. Cheney is talking about,” Hamilton says. [Shenon, 2008, pp. 381-385] No more evidence is found, and the commission ultimately sticks by their conclusions.

The conservative lobbying and advocacy group Citizens United (CU) attempts to rebut a 60 Minutes appearance by former President Bill Clinton by buying television time to accuse Clinton of leaving the US unprepared for the 9/11 attacks. Clinton appears on the CBS newsmagazine to discuss his upcoming autobiography, My Life. In the book, Clinton says that CU president David Bossie (see May 1998) helped to create the Whitewater scandal that plagued his second presidential term and led to his impeachment by the Republican-led House of Representatives. Bossie has published a book, Intelligence Failure, blaming the Clinton administration for leaving the country vulnerable to the 9/11 attacks. Bossie recently told an interviewer that he has been working on “uncovering the truth” about the Clinton administration for a decade. “I am going to make sure people remember the facts, not just what he wants people to remember,” he said. Bossie’s organization runs a commercial in several markets listing a number of terrorist attacks during Clinton’s two terms, and accusing Clinton of leaving the nation unprepared for the 9/11 assault. The CU refutation is just one of a number of conservative attacks on Clinton over his book, possibly because Clinton shows signs of being willing to join Democratic presidential candidate John Kerry (D-MA) on the campaign trail. A number of conservatives are advising the Kerry campaign to keep its distance from Clinton. [New York Times, 6/21/2004]

The head of the Justice Department’s Office of Legal Counsel (OLC), Jack Goldsmith (see June 17, 2004), Deputy Attorney General Jack Comey, and Justice Department lawyer Patrick Philbin brief reporters on the OLC’s decision to withdraw the department’s memos authorizing torture (see June 22, 2004). Comey explains that the statements about potential defenses against war crimes charges, and the commander in chief’s power to ignore anti-torture laws and treaties, are nothing more than “broad academic theories” that had never actually been relied upon to formulate policy. The “golden shield” memo (see August 1, 2002) is “under review and will be replaced with analysis limited to the legality of actual al-Qaeda interrogation practices and the torture statutes and other applicable laws.” Goldsmith’s decision to withdraw the memos causes what author and reporter Charlie Savage will later term “a final burst of apoplexy among the hard-liners on the Bush-Cheney legal team.” OLC lawyer John Yoo, who authored many of the withdrawn memos, will later write that Goldsmith’s decision set “a terrible precedent” and rendered “Justice Department judgments on the law… just one more political target open to political attack and political negotiations.” Yoo will accuse Goldsmith and Comey of being “too worried about public perceptions” of the department’s work. Televangelist Pat Robertson says the US should have merely assassinated Saddam Hussein instead of relying on a large and costly invasion to take out the Iraqi dictator. On CNN, Robertson answers a question about his previous warning that God thought the war could be a disaster. Robertson says: “Well, I don’t think God’s opposed to the war, necessarily, but it was a danger sign. I felt very uneasy about it from the very get-go. Whenever I heard about it, I knew it was going to be trouble. I warned the president.… I said, ‘You better prepare the American people for some serious casualties.’ And he said, ‘Oh, no, our troops are, you know, so well protected, we don’t have to worry about that.’ But it has been messy. And I think we’re going to come out of it, though. I think we’ll have a free Iraq. But it certainly has been a mess so far.… Our forces are going to war, and we support them. But if I had been doing it, I think I would have much preferred the assassination route. I think we could have gotten Saddam Hussein a lot easier than this.” [MSNBC, 6/22/2004] In 1999, Robertson advocated the assassination of the leaders of countries such as Serbia, Iraq, and North Korea, as well as Islamic militant leader Osama bin Laden (see August 9, 1999).

The Supreme Court rules in the case of Cheney v. US District Court for the District of Columbia (03-0475), in which two organizations, Judicial Watch and the Sierra Club, are attempting to force the White House to reveal information about the secret deliberations of Vice President Cheney’s energy task force (see April 27, 2004). Neither side gets what it asks for in the 7-2 ruling, as the Court sends the case back to the US Court of Appeals for further adjudication, with an order for that court to take a second look at its ruling that Cheney must allow a judge to review the task force documents (see August 2, 2002). Five justices—Stephen Breyer, Anthony Kennedy, Sandra Day O’Connor, Chief Justice William Rehnquist, and John Paul Stevens—vote to send the case back to the appeals court. Two justices, Ruth Bader Ginsburg and David Souter, vote to send the case all the way back to the original trial court, concurring with the majority. The Court’s two most conservative justices, Antonin Scalia and Clarence Thomas, vote to resolve the matter entirely in Cheney’s favor. Judge Anthony Kennedy, writing for the majority, instructs the appeals court—and all other courts who might subsequently hear such a case—to use a legal standard far more aligned with the executive branch’s claim of immunity from disclosure. Courts must afford “presidential confidentiality the greatest protection consistent with the fair administration of justice,” Kennedy writes, to protect the executive branch from being sued. Former Nixon White House counsel John Dean will later write that the Court may have avoided making a firm ruling because it did not want to wrangle with the issue of separation of powers, and the privilege of executive branch secrecy, in an election year. While most media and court observers call the decision a “punt” of little import, at least one, former Justice Department official Shannen Coffin, sees it differently. In a column for the National Review, Coffin celebrates the ruling, writing that due to “the vice president’s resolute assertion that he and the president should have the right to receive in confidence the advice necessary to the performance of their duties,” the White House has won a “major victory” in expanding its power to keep its procedures secret, regardless of the appeals court’s eventual ruling (see May 10, 2005). President Bush is interviewed for over an hour as part of the ongoing investigation into the Valerie Plame Wilson identity leak (see December 30, 2003). Bush, who is not sworn in, is interviewed by a team of federal prosecutors led by special counsel Patrick Fitzgerald. His lawyer, James Sharp (whom Bush has nicknamed “Shooter”), is also present during questioning (see June 5, 2004). White House press secretary Scott McClellan refuses to divulge any details of what Bush says to his interviewers, only telling reporters: “The leaking of classified information is a very serious matter. The president directed the White House to cooperate fully with those in charge of the investigation. He was pleased to do his part to help the investigation move forward.” Fitzgerald has already interviewed Vice President Dick Cheney (see May 8, 2004), and has called several current and former White House officials to testify before a grand jury. He has also subpoenaed a number of records, including White House phone logs. McClellan confirms that the interview with Bush and Sharp lasted about 70 minutes; asked if the White House had set a time limit on the interview, he says it would be “wrong to characterize it that way.” Even though Bush does not testify under oath, federal law requires him to be truthful in his statements, and he could be charged with making false statements if prosecutors found he lied or was evasive. Directly Contradicting Cheney - The media will later learn that Bush says he personally directed Cheney to lead a White House effort to counter allegations made by Plame Wilson’s husband, Joseph Wilson, that the White House had manipulated intelligence to make the case for war with Iraq (see March 9, 2003 and After). Bush also admits that he directed Cheney to disclose classified information that would both defend his administration and discredit Wilson. His testimony directly contradicts Cheney’s. Bush says he did not know that Cheney had told his then-chief of staff, Lewis “Scooter” Libby, to covertly leak the classified information to the media instead of releasing it to the public in the usual, overt fashion.
Denies Instructing Subordinates to Leak Plame Wilson Info - He also denies telling anyone to reveal Plame Wilson’s CIA status, and says he does not know who in his administration made her CIA status public knowledge. Libby has testified that neither Bush nor Cheney directed him or any other White House official to leak Plame Wilson’s identity. According to one senior government official, Bush told Cheney to “Get it out,” or “Let’s get this out,” regarding information that administration officials believed would rebut Wilson’s allegations and would discredit him. Another source with direct knowledge of the interview will later say that characterization is consistent with what Bush tells Fitzgerald. Libby told the grand jury that Cheney had told him to “get all the facts out” to defend the administration and besmirch Wilson. [National Journal, 7/3/2006]

The New York Times publishes an analysis of Harvard University’s admission policies towards Africans and African-Americans, and notes that while the admission of black students is rising, the percentages of those admitted are heavily skewed towards West Indian and African immigrants, and less so towards Americans of African descent. Some on the faculty say that African-American students were the intended recipients of affirmative action benefits more than non-Americans of African descent. Harvard professor Mary Waters says: “You need a philosophical discussion about what are the aims of affirmative action. If it’s about getting black faces at Harvard, then you’re doing fine. If it’s about making up for 200 to 500 years of slavery in this country and its aftermath, then you’re not doing well. And if it’s about having diversity that includes African-Americans from the South or from inner-city high schools, then you’re not doing well, either.” Another Harvard professor, Lani Guinier, whose ancestry includes Caucasians and Jamaicans, says: “Colleges and universities are defaulting on their obligation to train and educate a representative group of future leaders. And they are excluding poor and working-class whites, not just descendants of slaves.” [New York Times, 6/24/2004] Conservative pundit Tucker Carlson, discussing the article on PBS’s Tucker Carlson: Unfiltered, misrepresents the article in his opening discussion, saying: “Here’s something I bet you never thought you’d hear a liberal say: Harvard is letting in too many Africans. Yet that is exactly what a group of earnest liberals told the New York Times this week.” None of the academics and educators in the article say that Harvard or any other university is admitting “too many Africans,” or that Harvard needs to begin screening out African applicants. (Progressive media watchdog organization Media Matters later notes that the transcript of Carlson’s monologue alters Carlson’s remarks, adding the word “almost” in front of “exactly.”) Media Matters notes that Carlson is a critic of affirmative action, having recently equated the program with “good old-fashioned segregation” and accusing the program of “fighting racism with racism.” Carlson also states that the article says “between one-half and two-thirds of the black students at Harvard” are either West Indian or African, but the article cites no such statistics. He also misquotes Guinier, and attributes other statements to academics and educators quoted in the article that they did not make. [Media Matters, 6/30/2004]

The Coalition Provisional Authority (CPA - see April 17, 2003 and After and January 2003) notes in an internal report that while it lacks an accurate personnel count, it “believe[s] it had a total of 1,196 workers” in Baghdad, about half the authorized number. The Pentagon made up the shortfall by turning to the White House Liaison Office to recruit workers. The Liaison Office normally vets political appointees, and is staffed by right-wing ideologues with little practical experience outside Washington. As a result, the Liaison Office has sent hundreds of recruits to Baghdad who, in the phrasing of the CPA Inspector General, have “inconsistent skill sets.” Author and public policy professor Alasdair Roberts later notes that what the recruits lack in experience, ability, and qualifications, they make up in dogmatic adherence to right-wing ideology. One telling example is the group of CPA workers who manage the multi-billion dollar budget for the Iraqi government. Few, if any, have ever been to the Middle East, nor do any of them speak any of the region’s languages. None have any experience handling budgets of any real size. They are a group of recent college graduates, all in their twenties, who had submitted resumes for unrelated, lower-level jobs through the conservative Heritage Foundation. Roberts later writes, “The inexperience and partisanship of many CPA workers encouraged them to seize the moment and pursue reforms that were unneeded or impractical,” implementing what Roberts calls a “radical reconstruction of Iraqi society” based on neoconservative and fundamentalist dogma, with no understanding of, or concern for, Iraqi society. Many of the proposed reforms are later shelved as unworkable and dangerously provocative; one plan, to privatize Iraq’s state-run enterprises, is set aside for fear that it would lead to “popular unrest.” Most of the staff spend little time in Iraq before returning home; one CPA adviser calls them “90-day wonders getting their tickets punched that said, ‘I’ve been in Baghdad.’” [Roberts, 2008, pp. 127-128]

David Bossie (see May 1998), the head of the conservative lobbying group Citizens United (CU), accuses liberal filmmaker Michael Moore of improper involvement in the presidential campaign of Senator John Kerry (D-MA). Moore and the production company Lions Gate have released a new documentary, Fahrenheit 9/11, that is highly critical of the Bush administration (see June 25, 2004). Bossie says the film’s commercials, airing on network and cable television, are little more than campaign commercials devised to attack President Bush and assist Kerry. One commercial shows Bush on the golf course, talking about terrorism. In the clip, Bush tells a group of reporters, “We must stop these terrorist killers,” then turns his back, hefts his golf club, and says, “Now watch this drive.” The New York Times writes that “[t]he scene is one of many featured in the film that paint the president as cavalier, cynical, and insincere in the war against terrorism.” Republicans have for the most part ignored the film until recently, when ads for the film began drawing what they consider unwarranted attention. Bossie says: “There’s only a very small percentage of Americans that are going to go and see this movie. A much larger number are going to be bombarded by these political ads run by Michael Moore, potentially all the way through the election.” CU has run ads supportive of Bush (see (May 11, 2004)). Bossie has filed a complaint with the Federal Election Commission (FEC) asking that agency to classify the film’s ads as political, and restrict their broadcast according to campaign finance law (see March 27, 2002 and December 10, 2003). The law says that if found to be political, the ads must not be aired within 30 days of the start of the Republican National Convention on August 30. Legal experts say the FEC is unlikely to rule on the complaint for months, and even if the agency finds the ads to be political, the film could qualify for an exemption from the restrictions for news and commentary. Tom Ortenberg of Lions Gate says, “If we are still running television ads [by July 30], we will make certain that they are in full compliance with any and all regulations.” If they must remove Bush from the ads to remain in compliance, Ortenberg says “we can market this film without him.” Ortenberg denies that the ads have any political agenda. [New York Times, 6/27/2004] After Lions Gate agrees not to show ads for the film after July 30, the FEC will dismiss the complaint (see August 6, 2004).

In the case of Jose Padilla v. Donald Rumsfeld (see June 9, 2002), the Supreme Court votes 5-4 in favor of the government, declining to rule on the basis of a technicality. The majority argues that Padilla’s petition was incorrectly filed in New York rather than in South Carolina, where he is currently held. While Padilla was held in New York in preparation for an appearance before a grand jury, Defense Secretary Rumsfeld designated him an enemy combatant. Padilla was thereupon transferred to military custody and sent to a naval brig in South Carolina to be detained indefinitely. His lawyer meanwhile, unaware of her client’s transfer, filed a habeas corpus petition in New York against Rumsfeld (see June 11, 2002). This was erroneous, says the majority, which rules that Padilla has to re-file his petition in South Carolina. Four dissenting judges condemn the “secret transfer” of Padilla. Justice John Paul Stevens, writing for the minority, declares, “At stake in this case is nothing less than the essence of a free society.” Stevens also condemns the use of “incommunicado detention for months on end” as a means “to extract information” and places it among the “tools of tyrants.” [Supreme Court opinion on writ of certiorari. Shafiq Rasul, et al. v. George W. Bush, et al., 6/28/2004] Therefore, in essence, the majority declines to rule on the merits of the case. [Savage, 2007, pp. 193]

[Source: Dane101 (.com)]After the passage of the Bipartisan Campaign Reform Act of 2002 (BCRA—see March 27, 2002), also known as the McCain-Feingold law after its original sponsors, and the 2003 McConnell Supreme Court decision that upheld the law (see December 10, 2003), corporations and labor unions are prohibited from airing ads that attack candidates but avoid specific language that turns the ads from general commercials into “campaign” ads within 30 days of a primary election or 60 days of a federal election. Wisconsin Right to Life (WRTL) comes to anti-abortion and anti-campaign finance lawyer James Bopp Jr. (see November 1980 and After) with a dilemma. The WRTL wants to run ads attacking Senator Russ Feingold (D-WI), a powerful advocate of abortion rights, for his record of opposing President Bush’s judicial nominees. It intends to use the ads as campaign attack ads against Feingold, but skirt the BCRA’s restrictions by not specifically discouraging votes for him, thereby giving the appearance of “issue” ads and thusly not running afoul of the BCRA. Bopp is worried that the McConnell decision, just rendered, would make the Court reluctant to reverse itself so quickly. Bopp knows that the McConnell decision was in response to a broad challenge to the BCRA that argued the law was unconstitutional in all circumstances. Bopp decides to challenge the BCRA on behalf of the WRTL on narrower grounds—to argue that the specific application of the BCRA in this instance would violate the group’s First Amendment rights. He decides not to file a complaint with the Federal Election Commission (FEC) because of that agency’s notoriously slow response time, but instead files a preemptive challenge in court objecting to the BCRA’s ban on “issue advertisements” in the weeks before elections. Bopp is encouraged by the prospects of a court challenge that may wend its way to the Supreme Court, as the “swing” vote in McConnell was Justice Sandra Day O’Connor, who has been succeeded by the more conservative Samuel Alito (see October 31, 2005 - February 1, 2006). [New Yorker, 5/21/2012] Bopp will prove to be correct, as the Supreme Court will find in WRTL’s favor (see June 25, 2007).

In November 2002, as the 9/11 Congressional Inquiry was finishing its investigation, it had formally asked for a report by the Justice Department (which oversees the FBI) to determine “whether and to what extent personnel at all levels should be held accountable” for the failure to stop the 9/11 attacks. An identical request was made to the CIA (see June-November 2004). [New York Times, 9/14/2004] The Justice Department report, titled “A Review of the FBI’s Handling of Intelligence Information Related to the September 11 Attacks,” is completed this month. [Washington Post, 4/30/2005] It centers on three FBI failures before 9/11: the failure to follow up on the arrest of Zacarias Moussaoui in August 2001 (see August 16, 2001), the failure to follow up on FBI agent Ken Williams’ memo (see July 10, 2001) warning about Islamic militants training in US flight schools, and the FBI’s failure to follow up on many leads to hijackers Nawaf Alhazmi and Khalid Almihdhar. The report provides some new details about miscommunications, inaction, and other problems. [New York Times, 9/14/2004] The report remains classified. Senior Senate Judiciary Committee members Patrick Leahy (D-VT) and Charles Grassley (R-IA) call for its release. The senators state, “While the needs of national security must be weighed seriously, we fear the designation of information as classified, in some cases, serves to protect the executive branch against embarrassing revelations and full accountability. We hope that is not the case here.” [Washington Times, 7/12/2004; New York Times, 9/14/2004] One problem complicating the issuing of even a declassified version is the possibility that the material would taint the criminal proceedings against Zacarias Moussaoui. In early 2005, the Justice Department inspector general’s office will ask the judge presiding over Moussaoui’s case for permission to release a declassified version of the report. But the judge will turn down the request in April 2005, even after Moussaoui pleads guilty (see April 30, 2005). The report will finally be released in June 2005 without the section on Moussaoui (see June 9, 2005). [New York Times, 2/13/2005]

The White House sends a classified memo to the CIA. The contents of the memo will remain secret, but the American Civil Liberties Union (ACLU) and the Washington Post will later learn that it approves “harsh tactics” by CIA interrogators in questioning suspected terrorists. The memo was requested by CIA Director George Tenet, who asked for legal cover for the torture and harsh interrogation methods employed by CIA interrogators in the aftermath of the Abu Ghraib scandal. [Rolling Stone, 9/21/2006 pdf file] This produced a slight increase in the opinion polls and a media focus on the Kerry campaign. [MSNBC, 6/4/2007] Two days later, Homeland Security Secretary Tom Ridge warns that “Al-Qaeda is moving forward with its plans to carry out a large-scale attack in the United States in an effort to disrupt our democratic process.” [Department of Homeland Security, 7/8/2004] Officials cite “alarming” intelligence about a possible al-Qaeda strike inside the United States this fall and admit they are reviewing a proposal that could allow for the postponement of the November presidential election in the event of an attack. Officials point to the recent Madrid train bombings as an attempt by al-Qaeda to influence the political process in a democratic nation (see 7:37-7:42 a.m., March 11, 2004). Intercepted chatter leads one analyst to say, “they want to interfere with the elections.” It is reported that the Department of Homeland Security (DHS) recently asked the Justice Department’s Office of Legal Counsel to analyze the necessary legal steps that would permit the postponement of the election were an attack to take place. [Newsweek, 7/19/2004] The head of the US Election Assistance Commission, Deforest B. Soaries Jr., confirms he has written to Tom Ridge to discuss this prospect. [MSNBC, 6/4/2007] Soaries notes that, while a primary election in New York on September 11, 2001 was suspended by the State Board of Elections after the attacks, “the federal government has no agency that has the statutory authority to cancel and reschedule a federal election.” Soaries advises Ridge to seek emergency legislation from Congress that would grant such power to the DHS. DHS spokesman Brian Roehrkasse says, “We are reviewing the issue to determine what steps need to be taken to secure the election.” [Newsweek, 7/19/2004] A top European spy says of the threat, “I am aware of no intelligence, nothing that shows there will be an attack before the US presidential election.” No attack will materialize and no further information on the threat will be presented to the public. [Rolling Stone, 9/21/2006 pdf file] Ridge will later concede that he had no “precise knowledge” of the attack he warned against, and he never made plans to raise the color-coded threat level. On July 8, 2004, the New Republic predicts a “July surprise” from the Bush-Cheney reelection campaign involving the arrest of a high-value target in Pakistan by the end of the month. The magazine reports that in the spring of 2004, the administration increased pressure on Pakistan to kill or capture Osama bin Laden, his deputy, Ayman al-Zawahiri, or Taliban leader Mullah Mohammed Omar, all believed to be hiding in Pakistan. Bush officials such as CIA Director George Tenet, Secretary of State Colin Powell and his assistant, Christina Rocca, State Department counterterrorism chief Cofer Black, and others all visited Pakistan in recent months to urge Pakistan to increase its efforts in the war on terrorism. The New Republic comments, “This public pressure would be appropriate, even laudable, had it not been accompanied by an unseemly private insistence that the Pakistanis deliver these high-value targets (HVTs) before Americans go to the polls in November.” Bush spokespeople deny that the administration exerted any such pressure. But according to one source in the Pakistani ISI, “The Pakistani government is really desperate and wants to flush out bin Laden and his associates after the latest pressures from the US administration to deliver before the [upcoming] US elections.” Another source in the Pakistani Interior Ministry says, “The Musharraf government has a history of rescuing the Bush administration. They now want Musharraf to bail them out when they are facing hard times in the coming elections.” And another ISI source says that the Pakistanis “have been told at every level that apprehension or killing of HVTs before [the] election is [an] absolute must.” The Pakistanis have even been given a target date, according to the second ISI source: “The last ten days of July deadline has been given repeatedly by visitors to Islamabad and during [ISI director Lieutenant General Ehsan ul-Haq’s] meetings in Washington.” The source says that a White House aide told ul-Haq last spring that “it would be best if the arrest or killing of [any] HVT were announced on twenty-six, twenty-seven, or twenty-eight July”—the first three days of the Democratic National Convention in Boston. One Pakistani general said recently, “If we don’t find these guys by the election, they are going to stick this whole nuclear mess [relating to A. Q. Khan] up our _sshole.” The Bush administration apparently is using a carrot-and-stick approach to make sure such an arrest takes place on schedule. The New Republic observes: “Pushing Musharraf to go after al-Qaeda in the tribal areas may be a good idea despite the risks. But, if that is the case, it was a good idea in 2002 and 2003. Why the switch now? Top Pakistanis think they know: This year, the president’s reelection is at stake.” [New Republic, 7/29/2004] Pakistan will announce the capture of al-Qaeda leader Ahmed Khalfan Ghailani on July 29, just hours before Democratic presidential John Kerry’s acceptance speech at the Democratic National Convention. The authors of the New Republic article will claim vindication for their prediction (see July 25-29, 2004).

[Source: PBS]The Senate Intelligence Committee releases the 511-page Senate Report on Iraqi WMD intelligence, formally titled the “Report of the Select Committee on Intelligence on the US Intelligence Community’s Prewar Intelligence Assessments on Iraq.” [US Congress, 7/7/2004; CNN, 7/9/2004] All nine Republicans and eight Democrats signed off on the report without dissent, which, as reporter Murray Waas will write, is “a rarity for any such report in Washington, especially during an election year.” [National Journal, 10/27/2005]
Report Redacted by White House - About 20 percent of the report was redacted by the White House before its release, over the objections of both Republicans and Democrats on the committee. Some of the redactions include caveats and warnings about the reliability of key CIA informants, one code-named “Red River” and another code-named “Curveball” (see Mid- and Late 2001). The source called “Red River” failed polygraph tests given to him by CIA officers to assess his reliability, but portions of the report detailing these and other caveats were redacted at the behest of Bush administration officials. Widespread Failures of US Intelligence - The report identifies multiple, widespread failures by the US intelligence community in its gathering and analysis of intelligence about Iraq WMD, which led to gross misunderstandings and misrepresentations about Iraq’s WMD programs to the American public by government officials. Committee chairman Pat Roberts (R-KS), who has previously attempted to shift blame for the intelligence misrepresentations away from the Bush administration and onto the CIA (see July 11, 2003 and After), says that intelligence used to support the invasion of Iraq was based on assessments that were “unreasonable and largely unsupported by the available intelligence.” He continues: “Before the war, the US intelligence community told the president as well as the Congress and the public that Saddam Hussein had stockpiles of chemical and biological weapons and if left unchecked would probably have a nuclear weapon during this decade. Today we know these assessments were wrong.” Senator John D. Rockefeller (D-WV), the ranking Democrat on the 18-member panel that created the report, says “bad information” was used to bolster the case for war. “We in Congress would not have authorized that war with 75 votes if we knew what we know now,” he says (see October 10, 2002). “Leading up to September 11, our government didn’t connect the dots. In Iraq, we are even more culpable because the dots themselves never existed.” Numerous assertions in an October 2002 National Intelligence Estimate (NIE—see October 1, 2002) were “overstated” or “not supported by the raw intelligence reporting,” including:
bullet Claims that Iraq was rebuilding its nuclear weapons program;
bullet Claims that Iraq had large stockpiles of chemical and biological weapons;
bullet Claims that Iraq was developing an unmanned aerial vehicle that could be used to deliver chemical and/or biological weapons payloads onto distant targets;
bullet The so-called “layering effect,” where “assessments were based on previous judgments, without considering the uncertainties of those judgments” (Roberts calls it an “assumption train”);
bullet The failure to explain adequately the uncertainties in the October 2002 NIE to White House officials and Congressional lawmakers;
bullet Reliance on claims by “Curveball,” noting that the use of those claims “demonstrated serious lapses in handling such an important source”;
bullet Use of “overstated, misleading, or incorrect” information in helping then-Secretary of State Colin Powell present the administration’s case to the United Nations in February 2003 (see February 5, 2003); and
bullet The failure of the CIA to share significant intelligence with other agencies. [CNN, 7/9/2004; Cybercast News Service, 7/9/2004; New York Times, 7/9/2004]
“One fact is now clear,” Roberts says. “Before the war, the US intelligence community told the president as well as the Congress and the public that Saddam Hussein had stockpiles of chemical and biological weapons, and if left unchecked, would probably have a nuclear weapon during this decade. Well, today we know these assessments were wrong.” [Cybercast News Service, 7/9/2004; New York Times, 7/9/2004] Rockefeller says the intelligence community failed to “accurately or adequately explain the uncertainties behind the judgments in the October 2002 National Intelligence Estimate to policymakers.” The community’s “intelligence failures” will haunt America’s national security “for generations to come,” he says. “Our credibility is diminished. Our standing in the world has never been lower,” he says. “We have fostered a deep hatred of Americans in the Muslim world, and that will grow. As a direct consequence, our nation is more vulnerable today than ever before.” [CNN, 7/9/2004; New York Times, 7/9/2004]
'Group Think' and 'Corporate Culture' - Roberts says the report finds that the “flawed” information used to send the nation to war was the result of “what we call a collective group think, which led analysts and collectors and managers to presume that Iraq had active and growing WMD programs.” He says this “group think caused the community to interpret ambiguous evidence, such as the procurement of dual-use technology, as conclusive evidence of the existence of WMD programs.” Roberts blames “group think” and a “broken corporate culture and poor management,” which “cannot be solved by simply adding funding and also personnel.” [CNN, 7/9/2004; New York Times, 7/9/2004]
Lack of Human Intelligence in Iraq - Perhaps the most troubling finding, Roberts says, is the intelligence community’s near-total lack of human intelligence in Iraq. “Most alarmingly, after 1998 and the exit of the UN inspectors, the CIA had no human intelligence sources inside Iraq who were collecting against the WMD target,” he says. [CNN, 7/9/2004; New York Times, 7/9/2004]
No Connection between Iraq, al-Qaeda - Rockefeller says that the administration’s claims of an alliance between Iraq’s Saddam Hussein and al-Qaeda had no basis in fact: “[N]o evidence existed of Iraq’s complicity or assistance in al-Qaeda’s terrorist attacks, including 9/11.” The report says that intelligence claims of connections between Iraq and some terrorist activities were accurate, though the contacts between al-Qaeda and Iraq from the 1990s “did not add up to an established formal relationship.” [CNN, 7/9/2004; New York Times, 7/9/2004]
Divided Opinion on Pressure from Bush Administration - Republicans and Democrats on the committee differ as to whether they believe the CIA and other intelligence agencies groomed or distorted their findings as a result of political pressure from the White House. “The committee found no evidence that the intelligence community’s mischaracterization or exaggeration of intelligence on Iraq’s weapons of mass destruction capabilities was the result of politics or pressure,” Roberts says. However, Rockefeller notes that the report fails to explain fully the pressures on the intelligence community “when the most senior officials in the Bush administration had already forcefully and repeatedly stated their conclusions publicly. It was clear to all of us in this room who were watching that—and to many others—that they had made up their mind that they were going to go to war.” The analysts were subjected to a “cascade of ominous statements,” Rockefeller says, that may have pushed them to slant their analyses in the direction the White House indicated it wanted. The report finds that Vice President Dick Cheney and others who repeatedly visited intelligence agencies (see 2002-Early 2003) pressured intelligence analysts or officials to present particular findings or change their views. However, the report notes repeated instances of analysts exaggerating what they knew, and leaving out, glossing over, or omitting dissenting views. According to the report, the intelligence community released a misleading public version of the October 2002 NIE (see October 4, 2002) that eliminated caveats and dissenting opinions, thus misrepresenting “their judgments to the public which did not have access to the classified National Intelligence Estimate containing the more carefully worded assessments.” [CNN, 7/9/2004; New York Times, 7/9/2004; Cybercast News Service, 7/9/2004] In an interview the evening after the report’s release, Rockefeller is asked if the report documents “a failure of a system or is this a failure of a bunch of individuals who just did their jobs poorly?” Rockefeller responds: “This is a failure of a system.… It is not fair to simply dump all of this on the Central Intelligence Agency. The Central Intelligence Agency does not make the decision, and [former Director] George Tenet does not make the decision to go to war. That decision is made at the other end of Pennsylvania Avenue.… So we went to war under false pretenses, and I think that is a very serious subject for Americans to think about for our future.” Asked “if the president had known then what he knows now, he would have still taken us to war?” Rockefeller answers: “I can’t answer that question. I just ask—the question I ask is, why isn’t he, and maybe he is, why isn’t he as angry about his decision, so to speak his vote on this, as I am about mine?” [PBS, 7/9/2004]
Supporting the Claim of Iraq's Attempt to Purchase Nigerien Uranium - The report states flatly that senior CIA case officer Valerie Plame Wilson made the decision to send her husband, former ambassador Joseph Wilson, to Niger to investigate false claims that Iraq had attempted to purchase uranium from that nation (see February 21, 2002-March 4, 2002). The CIA has demonstrated that Plame Wilson did not make that decision (see February 19, 2002). However, as well as claiming that Plame Wilson sent Wilson to Niger, it claims that Wilson’s report, far from disproving the assertion of an attempt by Iraq to purchase uranium, actually bolstered that assertion. The report states that the question of Iraq’s attempt to buy Nigerien uranium remains “open.” It also says Wilson lied to the Washington Post in June 2004 by claiming that the documents used to support the claim were forgeries (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003). “Committee staff asked how the former ambassador could have come to the conclusion that the ‘dates were wrong and the names were wrong’ when he had never seen the CIA reports and had no knowledge of what names and dates were in the reports,” the report states. Wilson told committee members he may have been confused and may have “misspoken” to some reporters (see May 2, 2004). The committee did not examine the documents themselves. [Washington Post, 7/10/2009] The committee made similar claims a year before (see June 11, 2003 and July 11, 2003 and After). Progressive reporter and columnist Joshua Micah Marshall disputes the report’s claim that Wilson’s trip to Niger actually helped prove the assertion that Iraq tried to buy Nigerien uranium. The intelligence reports making the assertion are “fruits of the same poison tree” that produced so many other false and misleading claims, Marshall writes, and were based on the assumption that the forged documents were genuine. [Joshua Micah Marshall, 7/10/2004] In 2007, Plame Wilson will write, “What was missing from the [committee] report was just as telling as the distortions it contained. The ‘Additional Views’ section… had concluded” that she was responsible for sending Wilson to Niger. Yet that was contradicted by a senior CIA official over a year before. Plame Wilson will call the “Additional Views” section “a political smear if there ever was one,” crammed with “distortions and outright lies. Yet it continues to be cited today by Joe’s critics as proof of his lack of credibility.” The Wilsons learn months later that committee Democrats decided not to fight against the attacks on Wilson’s integrity; according to one of the senior Democratic senators on the panel, there was simply too much “incoming” from the Republicans for them to fight every issue. There were “far too many serious substantial disputes” that needed solving, and the Democrats chose to allow the attacks on Wilson to proceed without comment. [Wilson, 2007, pp. 187-190]
Portion of the Report Delayed - Roberts and other Republican majority committee members were successful in blocking Democrats’ attempts to complete the second portion of the report, which delineates the Bush administration’s use of the intelligence findings. That report will not be released until after the November 2004 presidential election. Rockefeller says he feels “genuine frustration… that virtually everything that has to do with the administration” has been “relegated to phase two” and will be discussed at another time. The second part of the committee’s investigation will focus on the “interaction or the pressure or the shaping of intelligence” by the Bush administration, Rockefeller says. “It was clear to all of us that the Bush administration had made up its mind to go to war,” he says, and he believes that such a “predetermination” influenced the intelligence community. Representative Jane Harman (D-CA), the ranking member of the House Intelligence Committee, says she hopes a similar House investigation would address some of those issues. However, she notes, she has been stymied by House Republicans in even launching that investigation. “There has not been the cooperation that there apparently has been on the Senate side,” she says. She has just now managed to wangle a meeting with House Intelligence Committee chairman Porter Goss (R-FL), who is being touted as the next director of the CIA (see September 24, 2004). Harman says, “I would hope we could address [the issues] factually and on a bipartisan basis, but at the moment I don’t have a lot of confidence in it.” [CNN, 7/9/2004; Cybercast News Service, 7/9/2004] Roberts’s spokeswoman Sarah Little later says that the committee has not yet decided whether the second portion of the report will be fully classified, declassified, or even if it will hold hearings. [National Journal, 10/27/2005]
Cheney, Roberts Colluded in Interfering with Report - Over a year later, the media will find that Roberts allowed Cheney and members of his staff to interfere with the committee’s investigation and dramatically limit its scope (see October 27, 2005). Rockefeller will say that he made three separate requests for White House documents during the committee’s investigation, but never received the documents he asked for. “The fact is,” Rockefeller will say, “that throughout the Iraq investigation any line of questioning that brought us too close to the White House was thwarted.” Rockefeller’s spokesperson, Wendy Morigi, will say that Rockefeller will “sadly come to the conclusion that the Intelligence Committee is not capable of doing the job of investigating the fundamental question as to whether the administration has misused intelligence to go to war.” [National Journal, 10/30/2005] Plame Wilson will write: “In the coming months, many reliable sources told us that before the report was issued, there was considerable collusion between the vice president’s office and… Roberts on how to craft the report and its content. So much for checks and balances and the separation of powers.” [Wilson, 2007, pp. 192]

July 11, 2004: Saudi-Terrorist Link Continues?

Senator Charles Schumer (D-NY) claims that Saudi leaders and members of the Saudi royal family continue to fund Islamic militant schools and groups in the US. He calls on the Bush administration to cut US ties with Saudi Arabia, and says, “There’s been much too close a relationship between Saudi royal family, the White House, and big oil. Author Clifford May, a former Republican National Committee staffer and a well-known television pundit, lambasts former ambassador Joseph Wilson’s new book, The Politics of Truth (see April 2004). May, who has written derisively about Wilson before (see September 29, 2003), opens by accusing Wilson of publishing a “quickie book sporting his dapper self on the cover” that contains little substance and is based largely on “a wet-kiss profile in Vanity Fair.” He derides Wilson’s lengthy experience as a diplomat (see July 31, 1990, August 1-2, 1990, August 6, 1990, August 8-9, 1990, September 20, 1990, and January 12, 1991) by calling him “the guy who makes sure the embassy plumbing is working and that the commissary is stocked with Oreos and other products the ambassador prefers.” Most notably, May comes to the conclusion that Wilson himself, and not the White House, outed his wife Valerie Plame Wilson as a CIA agent, a conclusion he says was reached by a “bipartisan Senate committee report.” May is referring to the recent report by the Senate Intelligence Committee (see July 9, 2004). He repeats many of the committee’s erroneous assertions, including the allegation that Wilson’s wife was responsible for the decision to send Wilson to Niger (see February 19, 2002, July 22, 2003, and October 17, 2003). In regards to President Bush’s State of the Union assertion that Iraq had attempted to buy uranium from Niger (see Mid-January 2003 and 9:01 pm January 28, 2003), May writes, “We now know for certain that Wilson was wrong and that Bush’s statement was entirely accurate.” He goes on to assert that the forged documents used to support the Iraq-Niger uranium story were likely “planted in order to be discovered—as a ruse to discredit the story of a Niger-Iraq link, to persuade people there were no grounds for the charge. If that was the plan, it worked like a charm.” May even says that Wilson’s report bolstered the belief that the uranium story might be true. He repeats his earlier charges that Wilson is an incompetent partisan whom the CIA had no business sending to Niger in the first place. He never explains exactly how Wilson outed his own wife as a CIA agent, though he does assert, wrongly, that Plame Wilson was never an undercover agent (see Fall 1992 - 1996) and therefore no one broke the law in revealing her status as a CIA official. [National Review, 7/12/2004] In 2004, Wilson will write of May’s assertion that his wife’s CIA status “was supposedly widely known” throughout Washington, “[I]f what May wrote was accurate, it is a damning admission, because it could have been widely known only by virtue of leaks among his own crowd.” [Wilson, 2004, pp. 443-444]

[Source: Associated Press]In a speech given at the Oak Ridge National Laboratory, President Bush defends the decision to invade and occupy Iraq as necessary for the nation’s safety. “Although we have not found stockpiles of weapons of mass destruction, we were right to go into Iraq,” he tells listeners. “I had a choice to make. Either take the word of a madman, or defend America. Given that choice, I will defend America every time.… We removed a declared enemy of America, who had the capability of producing weapons of mass murder, and could have passed that capability to terrorists bent on acquiring them. In the world after September the 11th, that was a risk we could not afford to take.” Bush is battling against recent findings by the Senate Intelligence Committee that showed his administration distorted and cherry-picked intelligence reports in its progress towards the invasion (see July 9, 2004). In his speech, Bush attempts to revise the rationale for invading Iraq. While the reasoning for invading was formerly the specter of Iraqi WMD imperiling the Middle East and even the US itself, now Bush asserts that invading Iraq and overthrowing Saddam Hussein was the first action of a larger, three-pronged strategy for peace. The strategy is, he says, “defending the peace, protecting the peace, and extending the peace.” He says, “We are defending the peace by taking the fight to the enemy,” in what the Washington Post calls “a subtle reformulation of the idea of ‘preemption’ that has been a centerpiece of his foreign policy since the Sept. 11, 2001, terrorist attacks.” Bush continues: “We have followed this strategy—defending the peace, protecting the peace, and extending the peace—for nearly three years. We have been focused and patient, firm and consistent. [The administration is] protecting the peace by working with friends and allies and international institutions to isolate and confront terrorists and outlaw regimes.” Both Iraq and Afghanistan are the beneficiaries of positive change, he says, as are Pakistan, Saudi Arabia, and Libya. Most importantly, he says, “the American people are safer.” [USA Today, 7/12/2004; White House, 7/12/2004; New York Times, 7/13/2004] Reading about Bush’s speech, senior CIA case officer Valerie Plame Wilson, an expert on Iraqi WMD, is bemused by Bush’s words. In 2007, she will write, “It was as if there were two wars: the one that the administration touted with pride, and the one that everyone else followed on their TVs and that wasn’t going as promised.” [Wilson, 2007, pp. 184]

As President Bush attempts to recast the Iraq invasion from being a military strike designed to eliminate the looming threat of Iraqi WMD into a larger strategy of bringing peace to the Middle East (see July 12, 2004), Vice President Dick Cheney adds a second thrust to the assertion by accusing Democrats of “trying to rewrite history for their own political purposes” when they criticize the administration for going to war based on flawed intelligence. Referring to Democratic presidential contenders Senators John Kerry (D-MA) and John Edwards (D-NC), who received some of the same intelligence reports the White House did before the war, Cheney says: “Now it seems they’ve both developed a convenient case of campaign amnesia. If the president was right—and he was—then they are simply trying to rewrite history for their own political purposes.” The Kerry campaign retorts that Bush and Cheney “are the ones with amnesia.… It’s as if they’ve forgotten that their go-it-alone foreign policy has made America bear the overwhelming share of casualties and costs in Iraq,” according to a campaign spokesman. While reviewing reports from Iraq, senior CIA case officer and WMD expert Valerie Plame Wilson admits a fellow CIA officer into her office. In 2007, Plame Wilson will recall: “His round face was flushed and his eyes, behind glasses, looked close to tears. I had worked with him for the last two years, through many stressful days, and I had never seen him so emotional or distressed.” After she closes the door, he says tightly, “They twisted my testimony.” Plame Wilson is not sure what he is talking about. ”I recommended Joe for the trip, don’t you remember?” he continues. “I told the committee this, but they didn’t include it in the report.” Plame Wilson realizes that the officer is talking about the recently released report from the intelligence committee on the prewar intelligence used to justify the Iraq invasion (see July 9, 2004), and referring to her husband, Joseph Wilson. She will write: “So when… the reports officer came to my office a day after the [committee] report came out, he confirmed what I had felt to be true—that I had not suggested Joe at all—but was afraid to voice without knowing for sure. He also reminded me of how the phone call to [another CIA officer] had started this chain of events (see February 13, 2002). A wave of apprehension swept over me. I wanted to urge my colleague to come forward again with the truth, but I couldn’t tell him what to do—it would be witness tampering.” [Wilson, 2007, pp. 192-193]
