Camp Casey. [Source: Indybay (.org)]Antiwar activist Cindy Sheehan, of Vacaville, California, sets up “Camp Casey” three miles outside of President Bush’s Crawford, Texas ranch. Bush has come to his ranch for his yearly August vacation; Sheehan has come to demand a meeting with Bush to discuss the loss of her son, Casey, in Iraq. Sheehan chooses the date to coincide with the fourth anniversary of the briefing that warned Bush of Osama bin Laden’s intention to attack the US (see August 6, 2001). Camp Casey begins as a single pup tent in a ditch by the side of a dirt road, in which Sheehan intends to stay for whatever time it takes to secure a meeting with Bush. Author and media critic Frank Rich later writes that because Bush is so firmly ensconsced in the protective “bubble” that shields him from awareness of criticism, he and his top officials are blindsided by the media response to Sheehan’s lonely vigil. Casey Sheehan, who died in April 2004 a mere two weeks after his arrival in Iraq (see April 4, 2004), will become, Rich will write, emblematic of both “the noble intentions of those who volunteered to fight the war [and] also the arrogance, incompetence, and recklessness of those who gave the marching orders.”
Bush Refuses to Meet with Sheehan - Bush will refuse to meet with Sheehan and the increasing number of peace activists who gather at Camp Casey, causing him inordinate embarrassment (see August 12, 2005) as more and more reporters begin questioning his motives in refusing to meet with the bereaved mother of a fallen US soldier. Bush even ignores the advice of some of his public relations staffers and fellow Republicans, who ask him to reconsider, as Senator George Allen (R-VA) says, “as a matter of courtesy and decency.” Rich will write: “Only someone as adrift as Bush would need to be told that a vacationing president couldn’t win a standoff with a grief-stricken parent commandeering TV cameras and the blogosphere 24/7. But the White House held firm. In a particularly unfortunate gesture, the presidential motorcade, in a rare foray out of the vacation compound, left Sheehan in the dust on its way to a fundraiser at a fat cat’s ranch nearby” (see August 12, 2005). [Rich, 2006, pp. 193-196] Political analyst Charlie Cook says: “Anything that focuses media and public attention on Iraq war casualties day after day—particularly [something] that is a good visual for television, like a weeping Gold Star mother—is a really bad thing for President Bush and his administration.… Americans get a little numb by the numbers of war casualties, but when faces, names, and families are added, it has a much greater effect.” Republican strategist Kellyanne Conway agrees, saying: “Cindy Sheehan has tapped into a latent but fervent feeling among some in this country who would prefer that we not engage our troops in Iraq. She can tap into what has been an astonishingly silent minority since the end of last year’s presidential contest. It will capture attention.” University professor Stephen Hess says that Sheehan’s “movement… can be countered by a countermovement” and therefore negated, but “I think the president might have defused the situation if he had invited her in instantly.” Hess predicts that Sheehan will soon be targeted by Republican strategists in a counterattack (see August 11, 2005 and After).
Focus of Antiwar Movement - Camp Casey quickly becomes the focus of the American antiwar movement, with organizations such as MoveOn.org and Code Pink pitching in to help expand and coordinate the camp, and high-profile Democratic operatives such as Joe Trippi organizing support among left-wing bloggers. MoveOn’s Tom Mattzie says: “Cindy reached out to us.… Cindy is a morally pure voice on the war, so we’re trying to keep the focus on her and not jump in and turn it into a political fight.” [Los Angeles Times, 8/11/2005]

National Security Adviser Stephen Hadley and White House deputy chief of staff Joe Hagin meet with antiwar protester Cindy Sheehan (see August 6, 2005 and After) for about 45 minutes. Sheehan, who has requested a meeting with President Bush during his vacation at his ranch in Texas, says she is not satisfied with the meeting with Hadley and Hagin. “I don’t believe his phony excuses for the war,” she says. “I want him to tell me why my son died (see April 4, 2004). If he gave the real answer, people in this country would be outraged—if he told people it was to make his buddies rich, that it was about oil.” [Los Angeles Times, 8/11/2005]
The Justice Department refuses to prosecute a White House event staffer who impersonated a Secret Service agent while improperly ejecting three people from a town-hall event featuring President Bush. The staffer will later be identified as Michael Casper (see March 21, 2005). The Secret Service recommended that Casper be prosecuted for impersonating a federal officer. The White House has refused to identify Casper, merely calling him a “White House volunteer.” US Attorney William Leone says: “Criminal law is not an appropriate tool to resolve this dispute. The normal give and take of the political system is the appropriate venue for a resolution.” Eight of Colorado’s nine US representatives have condemned the ejection. Marilyn Musgrove (R-CO), a longtime Bush ally, says, “I really do believe in free speech, and if you try to quell people it just makes them more determined.” [Los Angeles Times, 4/23/2005; OMB Watch, 8/8/2005]
Congress passes a law that forbids the Department of Energy, the Nuclear Regulatory Commission, and their contractors from firing or otherwise punishing any employee who informs Congress about possible wrongdoing. President Bush issues a signing statement that says only he or his appointees will decide whether employees of either agency can give information to Congress. [Boston Globe, 4/30/2006]
Former Clinton administration political consultant James Carville predicts that special counsel Patrick Fitzgerald will “com[e] after more people at the New York Times” in addition to Times reporter Judith Miller, who is in jail for refusing to cooperate with Fitzgerald’s investigation of the Valerie Plame Wilson identity leak (see July 6, 2005). Carville tells radio host Don Imus: “My sense is he’s coming after more people at the New York Times. He’s going to subpoena [executive editor] Bill Keller and all of them and ask them what Judy Miller told them. And if they don’t talk, he’s going to stick them in jail.” Carville also says that many people he talks to believe that Miller was used by the White House to “disseminate” Plame Wilson’s identity. “There are all sorts of rumors and I hear second hand that [Miller] was screaming out in the news room about this,” he says. The Times, Carville says, “to some extent is going to have to come clean. Because they’re going to have to tell us what Judy Miller knew, when she knew it, and who she told. And there’s a lot of people at the Times—and I know this to be a fact—who believe that.” Carville says it is difficult for Miller to claim First Amendment protections in refusing to discuss her knowledge of Plame Wilson’s identity leak. “It’s going to be very interesting to see whether [Miller’s] problem is a First Amendment [problem]—i.e., I want to protect a source—or a Fifth Amendment [problem]—I was out spreading this stuff too.” [NewsMax, 8/8/2005]
New Mexico Republican Party chairman Allen Weh, convinced that US Attorney David Iglesias is an incompetent who is deliberately refusing to prosecute voter fraud cases (see May 6, 2005 and After and May 12 - June 9, 2005), sends an email to Scott Jennings, an official in the White House Office of Political Affairs (OPA). He copies the email to Jennings’s supervisors Karl Rove and Sara Taylor (see Late January 2005), Republican National Committee official Timothy Griffin, and Steve Bell, the chief of staff to Senator Pete Domenici (R-NM). Weh writes in part: “We discussed the need to replace the US Atty in NM several months ago. The brief on voter fraud at the RNC [Republican National Committee] meeting last week reminded me of how important this post is to this issue, and prompted this follow up. As you are aware the incumbent, David Iglesias, has failed miserably in his duty to prosecute voter fraud. To be perfectly candid, he was ‘missing in action’ during the last election, just as he was in the 2002 election cycle. I am advised his term expires, or is renewed, in October. It is respectfully requested that strong consideration be given to replacing him at this point.… If we can get a new US Atty that takes voter fraud seriously, combined with these other initiatives we’ll make some real progress in cleaning up a state notorious for crooked elections.” Griffin responds in an email to Rove and Taylor: “I have discussed this issue with counsel’s office [the White House counsel’s office, headed by Harriet Miers]. I will raise with them again. Last time I spoke with them they were aware of the issue, and they seemed to be considering a change on their own. I will mention again unless I am instructed otherwise.” Twenty minutes later, Rove responds by telling Griffin, “Talk to the counsel’s office.” Griffin replies, “Done,” and adds a bit about setting up a meeting with someone unrelated to the Iglesias-Weh discussion. Rove responds, “Great.” He will later testify that he may have been responding to Griffin about the unrelated meeting. Right-wing commentators react to the sudden media presence of antiwar activist and bereaved mother Cindy Sheehan (see August 6, 2005 and After) with vitriolic criticism. (Author and media critic Frank Rich will later write of his belief that the anti-Sheehan campaign is orchestrated from the White House: “The attack was especially vicious because there was little the White House feared more than a critic who had more battle scars than a president or a vice president who had avoided Vietnam.”) Weekly Standard writer Fred Barnes tells Fox News viewers that Sheehan is a “crackpot.” Right-wing bloggers begin spreading lurid, and sometimes false, stories of her recent divorce and the opposition Sheehan receives from some of her family members. Because some of the Camp Casey protesters showed the recent Iraq documentary Fahrenheit 9/11 (see June 25, 2004), many right-wing commentators and pundits accuse Sheehan of being a tool of documentary filmmaker Michael Moore. Conservative pundit Michelle Malkin accuses Sheehan and other bereaved family members opposing the war of using their losses to promote their ideological agenda, and calls them “grief pimps.” The American Spectator says Sheehan’s own peace organization, Gold Star Families for Peace, “seeks to impeach George W. Bush and apparently to convince the US government to surrender to Muslim terrorists.” Talk-show host Rush Limbaugh makes the extraordinary claim that Sheehan is making up the entire story of her son’s death (see April 4, 2004), claiming that her loss “is nothing more than forged documents—there’s nothing about it that’s real.” Rich later notes that what he calls “the Swift Boating of Cindy Sheehan” has “failed, utterly.” He will continue: “The hope this time was that we’d change the subject to Cindy Sheehan’s ‘wacko’ rhetoric and the opportunistic left-wing groups that have attached themselves to her like barnacles. That way we would forget about her dead son. But if much of the 24/7 media has taken the bait, much of the public has not.… The public knows that what matters this time is Casey Sheehan’s story, not the mother who symbolizes it.” [Los Angeles Times, 8/11/2005; Washington Post, 8/13/2005; New York Times, 8/21/2005; Rich, 2006, pp. 194-195]

[Source: American Patriot Friends Network]President Bush and his motorcade drive past the growing camp of war protesters and peace activists nicknamed “Camp Casey” (see August 6, 2005 and After) without stopping, leaving the gathered protesters and bereaved family members literally in the dust. Bush is on his way to a fundraising barbecue expected to raise at least $2 million for the Republican National Committee. Camp founder Cindy Sheehan holds a sign that reads, “Why do you make time for donors and not for me?” The Associated Press reports, “It was unclear whether Bush, riding in a black Suburban with tinted windows, saw the demonstrators.” Bush has continued to refuse to meet with Sheehan and the others in Camp Casey, a makeshift camp three miles outside of his Crawford, Texas vacation ranch. The camp is attracting war protesters, peace activists, and bereaved family members who have lost loved ones in Iraq and Afghanistan. [Associated Press, 8/12/2005] The New York Times notes that in less than a week, Camp Casey has grown from one woman’s lonely vigil to a gathering of well over 100 protesters and family members, with visits from celebrities such as actor Viggo Mortensen and a full-time police presence. War supporters have blasted Sheehan and her companions, calling her everything from a traitor to a terrorist supporter, and arguing that the death of her son does not give her the right to criticize the war effort. Local supporters of Bush have suggested, among other things, that they unleash a gaggle of skunks on the camp to drive the protesters away; some have pretended to drive their pickup trucks into the crowds, and splashed protesters with mud as they revved their engines. [New York Times, 8/13/2005] Author and media critic Frank Rich will later write that the images of Bush’s motorcade ignoring Sheehan and the other protesters become embarrassing fodder for media comment and criticism. [Rich, 2006, pp. 194] The Times writes, “[Bush’s] five-week sojourn at his 1,600-acre ranch offers the protesters ample opportunity to camp out for extended periods in front of the national media at a time of sharp spikes in the casualties in Iraq, and as public polling data suggests the lowest support for the war since it began.” In a recent television ad paid for by her peace organization Gold Star Families for Peace, Sheehan said: “All I wanted was an hour out of his extended vacation time, but he’s refused to meet with me and the other military families. We just want honest answers.” [New York Times, 8/13/2005]
Deputy Attorney General James Comey, who has already tendered his resignation, gives his farewell speech to an assemblage in the Justice Department. Comey makes what author and reporter Charlie Savage will later call “a cryptic reference to the fights over warrantless surveillance and torture issues that he had fought alongside [former Office of Legal Counsel chief Jack] Goldsmith and the other non-team players” (see Late 2003-2005 and June 17, 2004). Comey tells the assembled employees that, during his tenure, he had dealt with issues that “although of consequence almost beyond my imagination, were invisible because the subject matter demanded it.” In these disputes, he says he worked with people whose loyalty “to the law… would shock people who are cynical about Washington.” Those people, he says, “came to my office, or my home, or called my cell phone late at night, to quietly tell me when I was about to make a mistake; they were people committed to getting it right—and to doing the right thing—whatever the price. These people know who they are. Some of them did pay a price for their commitment to [do] right, but they wouldn’t have it any other way.” [US Department of Justice, 8/15/2005; Consortium News, 2/8/2006; Savage, 2007, pp. 199] Comey will later testify that one of the people he is referring to is former Justice Department lawyer Patrick Philbin. Prince Bandar, Saudi ambassador to the US since 1983, steps down and is replaced by Prince Turki al-Faisal. It is said that Prince Bandar had been suffering health problems and is not close to the new Saudi King Abdullah (see August 1, 2005). Prince Turki was Saudi intelligence minister from the late 1970s until about one week before 9/11 (see August 31, 2001). Then he served three years as Saudi ambassador to Britain. Prince Turki has had a controversial past. He was considered a mentor to bin Laden, and encouraged him to represent Saudi Arabia in the Afghanistan war against the Soviet Union. There are allegations that Prince Turki took part in a series of secret meetings between bin Laden and the Saudis over a period of many years (see Summer 1991; May 1996; Spring 1998; June 1998; July 1998; July 4-14, 2001). There are also allegations that he went falcon hunting in Afghanistan with bin Laden during much of the 1990s (see 1995-2001). In the wake of his appointment as ambassador, US officials try to downplay his past. One unnamed US official says, “Yes, he knew members of al-Qaeda. Yes, he talked to the Taliban. At times he delivered messages to us and from us regarding Osama bin Laden and others. Yes, he had links that in this day and age would be considered problematic, but at the time we used those links.” The official adds that Prince Turki seems to have “gotten out of that business” since 2001 and “he understands that times have changed.” He was sued in 2002 by a group of 9/11 victims’ relatives for allegedly supporting al-Qaeda, but his name was dropped from the suit because of diplomatic immunity (see August 15, 2002). [Source: Foreign Policy Magazine]Right-wing Christian broadcaster Pat Robertson, a former Republican candidate for president, tells his viewing audience that the US should assassinate Venezuelan President Hugo Chavez. Robertson makes his statement on The 700 Club, the flagship broadcast of his Christian Broadcast Network. The US should assassinate Chavez to prevent Venezuela from becoming “a launching pad for communist infiltration and Muslim extremism.” Robertson says: “We have the ability to take him out, and I think the time has come that we exercise that ability. We don’t need another $200 billion war to get rid of one, you know, strong-arm dictator [referring to Iraq’s Saddam Hussein]. It’s a whole lot easier to have some of the covert operatives do the job and then get it over with.… You know, I don’t know about this doctrine of assassination, but if he thinks we’re trying to assassinate him, I think that we really ought to go ahead and do it. It’s a whole lot cheaper than starting a war… and I don’t think any oil shipments will stop.” [Associated Press, 8/22/2005; Foreign Policy, 10/22/2010]

[Source: Jim Watson / Agence France-Presse / Getty Images]The White House presents Tammy Pruett, whose four sons are serving in Iraq, as a counter to antiwar protester Cindy Sheehan, who lost her son Casey in Iraq (see August 6, 2005 and After). Unlike Sheehan, Pruett and her family staunchly support the war; also unlike Sheehan, Pruett has not lost any of her sons. Apparently the White House found Pruett after learning of her family’s appearance on CNN in June 2004, where she defended the war effort, and contacted the family a week before the event. “An obviously delighted President Bush,” who has repeatedly refused to meet with Sheehan (see August 12, 2005), flies to Idaho to introduce Pruett to what the Washington Post calls “a boisterous invitation-only audience mostly made up of military families.” Bush tells the audience: “There are few things in life more difficult than seeing a loved one go off to war. And here in Idaho, a mom named Tammy Pruett—I think she’s here—knows that feeling six times over. Tammy has four sons serving in Iraq right now with the Idaho National Guard—Eric, Evan, Greg, and Jeff. Last year, her husband Leon and another son, Eren, returned from Iraq, where they helped train Iraqi firefighters in Mosul. Tammy says this—and I want you to hear this—‘I know that if something happens to one of the boys, they would leave this world doing what they believe, what they think is right for our country. And I guess you couldn’t ask for a better way of life than giving it for something that you believe in.’ America lives in freedom because of families like the Pruetts.” Bush kisses Pruett on the cheek after the speech, then sends her out to talk to the press. Pruetts Offer Condolences to Sheehan, Other Bereaved Families - But the Pruetts are not willing to merely serve as props for the White House’s pro-war agenda. Both Leon and Tammy Pruett are quick to offer tearful condolences to families who have lost loved ones overseas, specifically naming Sheehan. Tammy says while her family supports the war, they do not want to be seen as criticizing those who oppose it. “We don’t feel like we’re out here trying to be a poster family, we’re just proud of our sons,” she says. Careful Staging - The Post notes that the Pruett speech is viewed by White House planners “as a crucial opportunity for Bush to show both compassion and resolve when his conduct of the war is increasingly being publicly questioned, and polls of public support are flirting with Vietnam War-era depths.” The speech and presentation are carefully crafted, with a drum corps playing the themes of each of the five branches of service, and Bush placed before a group of soldiers dressed in fatigues and arrayed in front of a huge red, white, and blue backdrop festooned with photographs of soldiers, police officers, firefighters, and rescue workers beneath the heading “Honoring America’s Soldiers.” The entire event, Knight Ridder reporter William Douglas writes, is designed to “creat[e] a visual link between the Sept. 11, 2001, terrorist attacks and the war in Iraq.” [MSNBC, 8/24/2005; Washington Post, 8/25/2005]

Angry community members in Smyrna and Ashland City, Tennessee, chase protesters from the virulently anti-gay Westboro Baptist Church (WBC—see November 27, 1955 and After), which has recently announced its intention to protest at the funerals of soldiers killed in Iraq and Afghanistan (see June 2005 and After). The WBC says God is punishing America for tolerating homosexuality by killing its soldiers in war, and its protests are designed to highlight that assertion. About 10 WBC members picket near the funerals of Staff Sergeant Asbury Fred Hawn II and Specialist Gary Reese Jr. Both were members of the Tennessee National Guard. Local residents have little sympathy for the WBC position; many chase the protesters’ cars down a highway, waving flags and shouting, “God bless America.” Local resident Connie Ditmore tells a reporter: “My husband is over there, so I’m here to show my support. To do this at a funeral is disrespectful of a family, no matter what your beliefs are.” The 10 WBC protesters are countered by hundreds of local residents, including many family members of other soldiers serving overseas. Sheriff’s deputies and state troopers are on hand to protect the protesters. As counter-demonstrators shout, “Get out of our town!” and “Get out of our country!” resident Danny Cotton says: “If they were protesting the government, I might even join them. But for them to come during the worst time for this family—it’s just wrong.” [Associated Press, 8/27/2005]
Conservative radio host Glenn Beck, in a joint attack on the Hurricane Katrina survivors and the families of the 9/11 victims, calls Katrina survivors “scumbags” and says how much he “hates” the families of the victims of the 9/11 attacks. Beck, whose daily radio show is syndicated by Premiere Radio Networks (a subsidiary of Clear Channel, which also syndicates many other conservative talk show hosts) and is broadcast to a weekly audiience of some 3 million listeners, acknowledges that no one “in their right mind is going to say this out loud.” He then savages both groups of victims and survivors. Beck says: “Let me be real honest with you. I don’t think anybody on talk radio—I don’t think anybody in their right mind is going to say this out loud—but I wonder if I’m the only one that feels this way. Yesterday, when I saw the ATM cards being handed out, the $2,000 ATM cards, and they were being handed out at the Astrodome. And they actually had to close the Astrodome and seal it off for a while because there was a near-riot trying to get to these ATM cards. My first thought was, it’s not like they’re going to run out of the $2,000 ATM cards. You can wait! You know, stand in line.… When you are rioting for these tickets, or these ATM cards, the second thing that came to mind was—and this is horrible to say, and I wonder if I’m alone in this—you know it took me about a year to start hating the 9/11 victims’ families? Took me about a year. And I had such compassion for them, and I really wanted to help them, and I was behind, you know, ‘Let’s give them money, let’s get this started.’ All of this stuff. And I really didn’t—of the 3,000 victims’ families, I don’t hate all of them. Probably about 10 of them. And when I see a 9/11 victim family on television, or whatever, I’m just like, ‘Oh shut up!’ I’m so sick of them because they’re always complaining. And we did our best for them. And, again, it’s only about 10. But the second thought I had when I saw these people and they had to shut down the Astrodome and lock it down, I thought: I didn’t think I could hate victims faster than the 9/11 victims. These guys—you know it’s really sad. We’re not hearing anything about Mississippi. We’re not hearing anything about Alabama. We’re hearing about the victims in New Orleans. This is a 90,000-square-mile disaster site, New Orleans is 181 square miles. A hundred and—0.2 percent of the disaster area is New Orleans! And that’s all we’re hearing about, are the people in New Orleans. Those are the only ones we’re seeing on television are the scumbags—and again, it’s not all the people in New Orleans. Most of the people in New Orleans got out! It’s just a small percentage of those who were left in New Orleans, or who decided to stay in New Orleans, and they’re getting all the attention. It’s exactly like the 9/11 victims’ families. There’s about 10 of them that are spoiling it for everybody.” [Media Matters, 9/9/2005]
Former members of the 9/11 Commission dismiss recent allegations regarding a secret military intelligence unit called Able Danger, which had been set up in 1999 to bring together information about al-Qaeda. Several former members of the unit have come forward claiming the program identified Mohamed Atta and three other 9/11 hijackers more than a year before the attacks (see August 17, 2005; August 22-September 1, 2005). The 9/11 Commission has been criticized for not mentioning Able Danger in its final report. In response, its former chairman, Thomas Kean, claims there is no evidence that anyone in the government knew about Mohamed Atta before 9/11, and there are no documents that verify the claims made by former members of the unit. However, the Pentagon has recently confirmed that documents associated with Able Danger were destroyed in accordance with regulations about gathering intelligence on people inside the US. Another former commissioner, Slade Gorton, says, “Bluntly, it just didn’t happen and that’s the conclusion of all 10 of us.” But a spokesman for Representative Curt Weldon (R-PA), who helped bring to light the existence of the program, says that none of the commissioners met with anyone from Able Danger, “yet they choose to speak with some form of certainty without firsthand knowledge.” [Associated Press, 9/15/2005; Fox News, 9/16/2005] The commission’s claim that no one in the US knew about Mohamed Atta before 9/11 is further contradicted by reports stating that the CIA had been tracking him while he was still in Germany, early in 2000 (see January-May 2000). And soon after 9/11, Newsweek reported US officials stating that Atta “had been known as [an associate] of Islamic terrorists” well before 9/11. [Newsweek, 9/20/2001 ]
Lewis “Scooter” Libby, the chief of staff for Vice President Dick Cheney, writes jailed reporter Judith Miller (see July 6, 2005) a chatty two-page letter that asserts he had wanted her to testify about their conversations all along. Miller is jailed pending her reversal of a decision not to reveal Libby as a confidential source; Libby had told Miller that former ambassador Joseph Wilson’s wife Valerie Plame Wilson was a CIA agent (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Libby’s letter comes after rounds of intensive negotiations between his lawyers, Miller’s lawyer Robert Bennett, and special counsel Patrick Fitzgerald. Libby says that he is glad to grant Miller a waiver of confidentiality which will allow her to testify about their conversations (see September 12, 2005), and says that a year earlier his lawyer had assured her lawyer that he had then waived confidentiality (see January 2-5, 2004). He reassures her that his decision to waive confidentiality is completely voluntary, and says he will actually be “better off” if she testifies. In conclusion, Libby writes: “You went into jail in the summer. It is fall now. You will have stories to cover—Iraqi elections and suicide bombers, biological threats and the Iranian nuclear program. Out West, where you vacation, the aspens will be turning. They turn in clusters, because their roots connect them. Come back to work—and life.” [Libby, 9/15/2005 ; New York Times, 9/29/2005] Miller will deny any hidden meaning in Libby’s last few lines, and deny to Fitzgerald that Libby attempted to “shape” her testimony in any way through the letter. [New York Times, 10/16/2005] Bennett will say he does not believe that Libby was trying to influence Miller’s testimony, but knew as soon as he read his letter that it would “be trouble” for her. “I know that the letter bothered [Judy] and it bothered me,” Bennett says. “She might be soon testifying, and a prosecutor might construe that as an attempt to influence her testimony. It was more probably just sort of a dumb thing to put in a letter.” Bennett will add: “I think it is important that Judy was protecting a source in terms of source confidentiality and the journalistic privilege. She was not protecting a source to prevent someone from going to jail. The letter just didn’t help matters.” [National Journal, 10/18/2005]
Author and journalist Melik Kaylan writes an op-ed for the Wall Street Journal advocating the mining of the entire Iraqi border—all 2,250 miles of it. Kaylan writes that if the US turned the entire Iraqi border into a minefield, the Iraqi insurrection could not be replenished with manpower and materiel from Syria and other sources. “Why has nobody publicly debated this idea?” he asks, and says the reason might be “the shock-horror-gasp factor” along with the late Princess Diana’s attempts to ban mines and bad memories of US mining efforts in Vietnam. However, he writes, “once tempers have cooled, it should become clear that of all the unpleasant products of war in Iraq, mining the border offers the least unpleasant.” The 2,250 mines can be laid out according to a strict plan, Kaylan advocates, and removed once hostilities have ended. “The point here is that a precisely ordered minefield is a weapon of peace, rather than war, a deterrent and a stabilizer,” he writes. “When done right, its aim is not to kill or maim but to take a swatch of territory out of the conflict—and to give relief to innocent border-area residents forced, at the point of a gun, to collaborate with infiltrators.” The proposal will not be given serious consideration by US or Iraqi war planners. The six-way talks over North Korea’s nuclear program (see August 2003 and Spring and Summer 2005) finally bear fruit: all participants, including North Korea and the US, agree to “the verifiable denuclearization of the Korean Peninsula in a peaceful manner.” The North Koreans had insisted that they were entitled to receive light-water nuclear reactors in return for disarming, a central provision of the 1994 Agreed Framework (see October 21, 1994). The US refused to agree, and the Chinese brokered a compromise statement in which North Korea “stated that it has the right to peaceful uses of nuclear energy” and that the “other parties expressed their respect” and will discuss the reactor demand “at an appropriate time.” But Bush administration conservatives, furious at the agreement, prevail on President Bush to modify the US’s position. The White House forces US negotiator Christopher Hill to read a hard-line statement written by Bush conservatives that defines the “appropriate time” for the reactor discussions as being after North Korea has unilaterally disarmed. Simultaneously, the Treasury Department announces its imposition of sanctions on an Asian bank for allegedly laundering North Korean funds. The North Koreans respond by walking out of the negotiations, leaving the agreement unsigned. They will not return to negotiations for 15 months. [BBC, 12/2007; Scoblic, 2008, pp. 244]
Nineteen US Representatives, headed by Lamar Smith (R-TX) and Darrell Issa (R-CA), send a letter to President Bush warning of a “crisis along the Southwest border” of the nation “that needs immediate attention.” Smith and his fellow signatories complain that “coyotes,” or criminals who smuggle illegal immigrants across the border in attempts to avoid immigration procedures and the US Border Patrol, constitute a grave threat to national security. Smith references the case of Antonio Amparo-Lopez, a “coyote” whom, after being arrested, was let go by Carol Lam, the US Attorney in Southern California (see February 2, 2004 and July 30, 2004). Lam and other Justice Department officials have cited a severe lack of resources in their decisions not to prosecute low-level alleged criminals such as Amparo-Lopez. The signatories ask Bush to “dedicate additional resources and direct US Attorneys in the Southwest region to make the prosecution of human smugglers a priority.” Representative Randall “Duke” Cunningham is one of the signatories; he is under investigation by Lam’s office for corruption. Six weeks later, the Justice Department’s Office of Legislative Affairs sends what conservative columnist Byron York will call “a brush-off letter” in response. Senator Pete Domenici (R-NM) contacts Attorney General Alberto Gonzales (see February 14, 2005), by conference call, to complain about the “job performance” of New Mexico’s US Attorney, David Iglesias (see October 18, 2001). Meeting participants include Domenici, Gonzales’s deputy chief of staff Kyle Sampson, and Assistant Attorney General William Moschella. According to Moschella’s day planner, Gonzales will call Domenici, apparently after the telephone call. Domenici cites “public corruption cases” as part of his concerns with Iglesias’s performance. [US Department of Justice, 3/13/2007 ; US Department of Justice, 3/23/2007 ; US Department of Justice, Office of the Inspector General, 9/29/2008; Talking Points Memo, 2011] It is not known if previous complaints regarding Iglesias from New Mexico’s Republican Party chairman Allen Weh (see May 6, 2005 and After) are part of the reason why Domenici is complaining about Iglesias. Domenici has received at least one complaint Weh sent to the White House (see August 9, 2005).
William Bennett. [Source: Ashbrook Center, Ashland University]William Bennett, the conservative radio host, Fox News contributor, and former secretary of education under Ronald Reagan, tells his listeners that one way to drop the US crime rate would be to “abort every black baby in this country.” Bennett, who reaches a weekly audience of some 1.25 million, is apparently going off a claim in the economic treatise Freakonomics by Steven Levitt and Stephen Dubner, who argued that legalized abortion has lowered crime rates, since many aborted fetuses, growing up in poor homes and in single-parent or teenaged-parent homes, would have been more likely to commit crimes. Levitt and Dubner made no race-based claims. A caller to Bennett’s show says the national media “talk[s] a lot about the loss of revenue, or the inability of the government to fund Social Security, and I was curious, and I’ve read articles in recent months here, that the abortions that have happened since Roe v. Wade (see January 22, 1973), the lost revenue from the people who have been aborted in the last 30-something years, could fund Social Security as we know it today. And the media just doesn’t—never touches this at all.” After some back-and-forth about assumptions over how many of those aborted fetuses would have grown up to be productive citizens, speculations about costs, and Bennett’s citation of the Freakonomics claim, he says: “I do know that it’s true that if you wanted to reduce crime, you could—if that were your sole purpose, you could abort every black baby in this country, and your crime rate would go down. That would be an impossible, ridiculous, and morally reprehensible thing to do, but your crime rate would go down. So these far-out, these far-reaching, extensive extrapolations are, I think, tricky.” [Media Matters, 9/28/2005; CNN, 9/30/2005] Bennett will face heavy criticism for his remarks (see September 29-30, 2005), but in his turn will claim that he is the one owed the apology (see September 30 - October 1, 2005).
Conservative radio host and former Secretary of Education William Bennett is castigated by both liberals and conservatives for his statement that aborting all black children would lower the US crime rate (see September 28-October 1, 2005). President Bush’s press secretary, Scott McClellan, tells reporters that Bush “believes the comments were not appropriate,” though he does not actually condemn Bennett’s words, as requested by House Minority Leader Nancy Pelosi (D-CA). Pelosi says: “What could possibly have possessed Secretary Bennett to say those words, especially at this time? What could he possibly have been thinking? This is what is so alarming about his words.” Senate Minority Leader Harry Reid (D-NV) says he is “appalled” by Bennett’s remarks. “The Republican Party has recently taken great pains to reach out to the African-American community, and I hope that they will be swift in condemning Mr. Bennett’s comments as nothing short of callous and ignorant,” he adds. Representative Bobby Rush (D-IL), an African-American, says, “This is precisely the kind of insensitive, hurtful, and ignorant rhetoric that Americans have grown tired of.” Rush asks “my friends, the responsible Republicans” to pass a House resolution condemning Bennett’s remarks as “outrageous racism of the most bigoted and ignorant kind.” He asks: “Where is the indignation from the GOP, as one of their prominent members talk about aborting an entire race of Americans as a way of ridding this country of crime? How ridiculous! How asinine! How insane can one be?” Instead, Rush calls for the “aborting” of Republican policies, “which have hurt the disadvantaged, the poor average Americans for the benefit of large corporations.” Bruce Gordon, president of the National Association for the Advancement of Colored People (NAACP), says Bennett and his employer, the Salem Radio Network, owe the nation an apology. “In 2005, there is no place for the kind of racist statement made by Bennett,” he says in a statement. “While the entire nation is trying to help survivors, black and white, to recover from the damage caused by Hurricanes Katrina and Rita, it is unconscionable for Bennett to make such ignorant and insensitive comments.” [CNN, 9/30/2005]
Ignorance, Stereotyping Blacks as Born Criminals - In a press release, Howard Dean, the chairman of the Democratic National Committee (DNC), says: “Are these the values of the Republican Party and its conservative allies? If not, President Bush, Ken Mehlman [Dean’s Republican counterpart], and the Republican Leadership should denounce them immediately as hateful, divisive, and worthy only of scorn. This kind of statement is hardly compassionate conservatism; rather, Bennett’s comments demonstrate a reprehensible racial insensitivity and ignorance. Bill Bennett’s hateful, inflammatory remarks regarding African Americans are simply inexcusable. They are particularly unacceptable from a leader in the conservative movement and former secretary of education, once charged with the well-being of every American school child. He should apologize immediately. As Americans, we should focus on the virtues that bring us together, not hatred that tears us apart and unjustly scapegoats fellow Americans.” [Democratic National Committee, 9/29/2005] Senator Patrick Leahy (D-VT), says: “I’m not even going to comment on something that disgusting. Really, I’m thinking of my black grandchild and I’m going to hold [off].” [ABC News, 9/29/2005] The Reverend Jesse Jackson, a former Democratic presidential candidate and former associate of civil rights leader Dr. Martin Luther King, says: “Republicans, Democrats, and all Americans of goodwill should denounce this statement, should distance themselves from Mr. Bennett. And the private sector should not support Mr. Bennett’s radio show or his comments on the air.” [Guardian, 10/1/2005]
Civil Rights Leader: Bennett's Show Should be Canceled - Wade Henderson, the executive director of the Leadership Conference on Civil Rights, says an apology is insufficient; Bennett’s radio program should be canceled. Referring to inaccurate news reports that blacks were responsible for a “crime wave” in New Orleans in the aftermath of Hurricane Katrina, Henderson says, “I think African-Americans are certainly tired of being stereotyped as being responsible for the majority of crime in American society when the facts simply don’t bear that assumption out.” [CBS News, 9/30/2005]

New York Times reporter Judith Miller is released from jail after agreeing to comply with a subpoena from the grand jury investigating the Valerie Plame Wilson identity leak (see July 6, 2005). According to Miller, the person who told her of Plame Wilson’s covert identity, former vice-presidential chief of staff Lewis “Scooter” Libby, “voluntarily and personally released me from my promise of confidentiality” (see September 15, 2005 and October 28, 2005). [Washington Post, 7/3/2007] Libby’s lawyer Joseph Tate says that his client released Miller from her confidentiality agreement over a year ago, and that he was surprised to learn that Miller and her lawyer, Robert Bennett, did not know that she was free to testify. “We told her lawyers it [Libby’s original waiver] was not coerced,” Tate says. “We are surprised to learn we had anything to do with her incarceration” (see September 12, 2005). [Washington Post, 9/30/2009] Times publisher Arthur Sulzberger says: “Judy has been unwavering in her commitment to protect the confidentiality of her source. We are very pleased that she has finally received a direct and uncoerced waiver, both by phone and in writing, releasing her from any claim of confidentiality and enabling her to testify.” Miller adds: “I went to jail to preserve the time-honored principle that a journalist must respect a promise not to reveal the identity of a confidential source. I chose to take the consequences—85 days in prison—rather than violate that promise. The principle was more important to uphold than my personal freedom.” [New York Times, 9/29/2005] In preparation for her upcoming testimony (see September 30, 2005), Sulzberger and Times executive editor Bill Keller take Miller from jail to have a massage, a manicure, a martini, and a steak dinner before she goes home to sleep in her own bed. A day before New York Times reporter Judith Miller is scheduled to testify before the grand jury investigating the Plame Wilson identity leak (see September 30, 2005), Miller’s attorney, Floyd Abrams, writes a letter to Lewis Libby’s attorney, Joseph Tate, alleging that Tate had repeatedly made comments to him that may have been intended to discourage Miller from testifying. Miller is expected to provide testimony that will contradict Libby, the former chief of staff to Vice President Dick Cheney, who has testified that he never provided Valerie Plame Wilson’s identity as a CIA agent to Miller (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Miller was concerned that Libby would not provide her with a specific waiver of confidentiality, without which she was unwilling to testify. Libby had signed a general waiver provided by special counsel Patrick Fitzgerald, but Miller did not consider that as enough of a release from her obligation to protect him, her source. Miller has said that she spent 85 days in jail (see July 6, 2005) because Tate told her that the general waiver was not given freely. Libby provided her with a specific waiver two weeks ago (see September 15, 2005). Abrams writes that Tate told him that the general waiver was “by its nature coerced and had been required as a condition for Mr. Libby’s continued employment at the White House.” Abrams writes in part: “In our [various] conversations… you did not say that Mr. Libby’s waiver was uncoerced. In fact, you said quite the opposite. You told me that the signed waiver was by its nature coerced and had been required as a condition for Mr. Libby’s continued employment at the White House. You compared the coercion to that inherent in the effective bar imposed upon the White House employees asserting the Fifth Amendment. A failure by your client to sign the written waiver, you explained, like any assertion of your client of the Fifth Amendment, would result in his dismissal. You persuasively mocked the notion that any waiver signed under such circumstances could be deemed voluntary.” Tate says that Abrams’s claims are “outrageous” and “factually incorrect,” and that neither he nor Libby has said or done anything to discourage Miller from testifying or to influence any testimony she might give. Abrams says that Tate provided him with some information from Libby’s previous testimony to the grand jury (see March 5, 2004 and March 24, 2004), and attempted to find out from him what Miller might testify to. He says he refused to provide Tate with any such information. Miller has also written that Tate expressely asked her not to “go there” when she refused to say that her testimony would exonerate Libby, but other sources have said Tate did not say anything of that nature to her. The Washington Post publishes an article, written by Susan Schmidt and Jim VanderHei, that reveals details of White House official Lewis Libby’s conversations with New York Times reporter Judith Miller (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Miller has just been released from jail (see September 29, 2005) after receiving a confidentiality waiver from Libby (see September 15, 2005). The details of the Libby-Miller conversations come from a source the reporters call “familiar with Libby’s account of his conversations with Miller in July 2003.” According to the source, Libby told Miller he heard that former ambassador Joseph Wilson’s wife, Valerie Plame Wilson, “had something to do with sending him” to Niger (see February 21, 2002-March 4, 2002), “but he did not know who she was or where she worked, the source said.” The reporters then write that during his second conversation with Miller, Libby said he had learned that Plame Wilson “had a role in sending him on the trip and that she worked for the CIA. Libby never knew Plame’s name or that she was a covert operative, the source said.” The source also told the reporters that Libby never spoke with columnist Robert Novak about Plame Wilson (see July 14, 2003). [Washington Post, 9/30/2009] The source “familiar with Libby’s” testimony was repeating the same falsehoods that Libby told the Plame Wilson grand jury (see March 5, 2004 and March 24, 2004). Miller will testify that in their first conversation, Libby told her that Wilson’s wife worked for the CIA’s Weapons, Intelligence, Non-Proliferation, and Arms Control office (see September 30, 2005, October 7, 2005, and October 12, 2005). [National Journal, 10/18/2005] Author and blogger Marcy Wheeler will later write that she believes Libby used the Post story to attempt to “coach” Miller’s testimony. Both Wheeler and reporter Murray Waas will note that the same anonymous source quoted in the Schmidt/VandeHei story attempted, and failed, to get articles based on the same information published in two other newspapers. Waas will write: “Journalists at two news organizations declined to publish stories. Among their concerns was that they had only a single source for the story and that that source had such a strong bias on behalf of Libby that the account of his grand jury testimony might possibly be incomplete or misleading in some way. But more important were concerns that a leak of an account of Libby’s grand jury testimony, on the eve of Miller’s own testimony, might be an effort—using the media—to let Miller know what Libby had said, if she wanted to give testimony beneficial to him, or similar to his. (There is no evidence that Miller did not testify truthfully to the grand jury.)” Wheeler accuses Schmidt of being Libby’s “stenographer,” a reporter all too willing to publish whatever a person wishes without investigating the possible motives behind the provision of the information. Wheeler also believes Libby may have attempted to coach or influence Miller’s testimony in his letter releasing the reporter from their confidentiality agreement (see September 15, 2005). Imam Intikab Habib. [Source: Newsday]Imam Intikab Habib, who is due to be sworn in as New York City Fire Department’s second ever Muslim chaplain, expresses doubts about the official US government story as to who is responsible for the 9/11 attacks. 30-year-old Habib, a native of Guyana who has lived in New York since 2000, tells New York’s Newsday, “I as an individual don’t know who did the attacks. There are so many conflicting reports about it. I don’t believe it was 19… hijackers who did those attacks.” He says, “I’ve heard professionals say that nowhere ever in history did a steel building come down with fire alone. It takes two or three weeks to demolish a building like that. But it was pulled down in a couple of hours. Was it 19 hijackers who brought it down, or was it a conspiracy?” [Newsday, 9/30/2005] After making the comments, and shortly before he is due to be sworn in as chaplain, Habib resigns. Fire Commissioner Nicholas Scoppetta tells reporters, “It became clear to him that he would have difficulty functioning as a Fire Department chaplain. And then I understand the head of the Islamic Society of the Fire Department… told him they were withdrawing their support.” [Associated Press, 9/30/2005; Newsday, 10/1/2005]
Columnist Bob Herbert accuses Bennett of ‘racial effrontery.’ [Source: Louisville Courier-Journal]William Bennett, the conservative radio host who is facing heavy criticism for suggesting that aborting black children would lower the US crime rate (see September 28-October 1, 2005 and September 29-30, 2005), defends his position by saying: “I was putting forward a hypothetical proposition. Put that forward. Examined it. And then said about it that it’s morally reprehensible. To recommend abortion of an entire group of people in order to lower your crime rate is morally reprehensible. But this is what happens when you argue that the ends can justify the means.… I’m not racist, and I’ll put my record up against theirs,” he says, referring to leading Democrat Nancy Pelosi and other critics. “I’ve been a champion of the real civil rights issue of our times—equal educational opportunities for kids. We’ve got to have candor and talk about these things while we reject wild hypotheses,” Bennett says. “I don’t think people have the right to be angry, if they look at the whole thing. But if they get a selective part of my comment, I can see why they would be angry. If somebody thought I was advocating that, they ought to be angry. I would be angry. But that’s not what I advocate.” Bennett says he owes no one an apology: “I don’t think I do. I think people who misrepresented my view owe me an apology.” [CNN, 9/30/2005]
Says Topics of Race and Crime Cannot Be off-Limits - Later, he continues to defend his remarks, saying, “It would have worked for, you know, single-parent moms; it would have worked for male babies, black babies.” Asked why he would bring the subject up at all, Bennett says: “There was a lot of discussion about race and crime in New Orleans. There was discussion—a lot of it wrong—but nevertheless, media jumping on stories about looting and shooting, and roving gangs and so on. There’s no question this is on our minds.… What I do on our show is talk about things that people are thinking… we don’t hesitate to talk about things that are touchy. I’m sorry if people are hurt, I really am. But we can’t say this is an area of American life [and] public policy that we’re not allowed to talk about—race and crime.” [ABC News, 9/29/2005; Guardian, 10/1/2005]
Feeding Perception that Republicans are Racist - Robert George, a black conservative editorial writer for the New York Post, agrees that Bennett did not mean his remarks as racist. But, he says, he worries that Bennett is feeding the perception that Republicans are racist. “His overall point about not making broad sociological claims and so forth, that was a legitimate point,” George says. “But it seems to me someone with Bennett’s intelligence… should know better the impact of his words and sort of thinking these things through before he speaks.” [ABC News, 9/29/2005] Bob Herbert, a black progressive columnist for the New York Times, later says he was unsurprised by Bennett’s remarks: “I’ve come to expect racial effrontery from big shots in the Republican Party. The GOP has happily replaced the Democratic Party as a safe haven for bigotry, racially divisive tactics and strategies, and outright anti-black policies. That someone who’s been a stalwart of that outfit might muse publicly about the potential benefits of exterminating blacks is not surprising to me at all.… Bill Bennett’s musings about the extermination of blacks in America (it would be ‘impossible, ridiculous, morally reprehensible’) is all of a piece with a Republican Party philosophy that is endlessly insulting to black people and overwhelmingly hostile to their interests.” [New York Times, 10/6/2005]

[Washington Post, 7/3/2007] In some respects Miller’s testimony is less than enlightening. She admits that Lewis Libby was the source that she was protecting (see September 15, 2005), but says that she doesn’t believe Libby told her Plame Wilson’s name. In the same notebook Miller used to take notes from her conversations with Libby (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003), Miller wrote “Valerie Flame,” an apparent misspelling. Asked why that name appears in the notebook alongside the notes from her conversations with Libby, Miller equivocates, saying she doesn’t believe she heard the name from Libby. She will later write of her testimony, “I said I believed the information came from another source, whom I could not recall.” As a side note, the Times only now reveals Libby as Miller’s source, though other news outlets have already identified Libby. [New York Times, 10/16/2005] Miller testifies that she does not recall her first meeting with Libby, which took place June 23. She will change her testimony (see October 7, 2005 and October 12, 2005) after prosecutor Patrick Fitzgerald shows her Secret Service logs showing that she had met with Libby in the Executive Office Building. [National Journal, 10/20/2005] This memory lapse is consistent with theories that Miller may be attempting to protect Libby by failing to testify about that first meeting, where Libby informed Miller that Plame Wilson was a CIA official working in the Weapons, Intelligence, Non-Proliferation, and Arms Control office (see September 29-30, 2005). Miller also testifies that Libby saw the media’s reporting of the Iraq-Niger story as the product of “selective leaking” by the CIA. The purpose of the CIA leaks, Miller says Libby believed, was to protect the agency if no WMD were found in Iraq. [Roberts, 2008, pp. 151]
Conservative radio host Rush Limbaugh encourages an African-American caller who describes liberalism as “a form of mental illness” that is “actually a type of rebellion against God and virtue through the justification of… immorality, things like abortion, homosexuality, promiscuity, prostitution, racism, even race-centered thinking.” Limbaugh restates the caller’s comment, saying: “So liberalism is a mental illness. It’s borne of people that do not like any judgmentalism against their depravity.” The caller, identified only as “Eric from Charlotte, North Carolina,” then describes black civil rights leader Jesse Jackson, black radio hosts Tavis Smiley and Tom Joyner, Representative Charles Rangel (D-NY), and “all of the Democratic delegation up there in Congress… the Ted Kennedys (D-MA),” and “anybody who’s in the leadership position in the Democratic Party” as “pimps” who attempt to deceive black people into remaining on the “Democratic plantation,” and says Democrats suffer from “the slave, slave master, slave-liberator mentality.” Democratic leaders are “all mentally ill,” he continues, and tells Limbaugh: “The Bible actually calls them ‘fools’ because they’re rebelling against virtue and God. Now, I’m not calling them fools, I’m just saying the Bible calls them fools.” Limbaugh encourages the caller, saying, “If the Bible can call them fools, you can echo the Bible,” to which the caller replies, “I’m calling them fools through the Bible.” Republicans and “those on the religious right… are the preachers and the liberators trying to tell the truth about what the Democratic leadership—the Democrats are doing to black people.” Limbaugh rewards the caller with a free year’s subscription to his Web site. Representative Jane Harman (D-CA) is recorded telling a suspected Israeli agent that she would intervene with the Justice Department to try to get charges against two Israeli lobbyists reduced. In return, the Israeli agent promises to help Harman secure the chairmanship of the House Intelligence Committee. The Israeli agent will remain unidentified; the two lobbyists, Steve Rosen and Keith Weissman, are charged with espionage after they allegedly passed along classified information to the American Israel Public Affairs Committee (AIPAC—see April 13, 1999-2004). The conversation between Harman and the Israeli agent is recorded on an wiretap, reportedly by the NSA, mounted as part of a federal investigation into AIPAC’s potential espionage operations against the US (see October 5, 2005). According to transcripts of the wiretapped conversation, Harman agrees to “waddle into” the AIPAC case “if you think it’ll make a difference.” The Israeli agent asks Harman if she could speak with Attorney General Alberto Gonzales on Rosen’s and Weissman’s behalf. Harman replies that Gonzales might not cooperate, because he “just follows White House orders,” but other officials might be more pliable. In return, the Israeli agent promises to contact House Minority Leader Nancy Pelosi (D-CA) and attempt to persuade her to name Harman as chairwoman of the Intelligence Committee if the Democrats win control of the House in the November 2006 elections. Harman tells the agent, “This conversation doesn’t exist,” and hangs up. The contents of the conversation will later be confirmed by three separate sources, including two former senior national security officials. [Congressional Quarterly, 4/19/2009] Reporter Marc Ambinder will later write that Harman’s conversation may have been recorded by the FBI, and not the NSA, as part of the its investigation into Rosen and Weissman. In an essay for the Virginia Law Review entitled “Liberalism, Torture, and the Ticking Bomb,” Georgetown law professor David Luban dismantles the familiar argument that torture of a detainee might be necessary to stop the so-called “ticking bomb scenario.” Author and former White House counsel John Dean, who quotes Luban in his 2006 book Conservatives Without Conscience, will describe the scenario and its ramifications thusly: “A nuclear bomb has been planted in the heart of a major American city and authorities have in custody a person who knows where it is located. To save possibly millions of lives, would it not be justified to torture this individual to get the necessary information to stop it? Absolutely. Is not this lesser evil justified? Of course it is. And this argument is a wonderful means to comfort those who have moral problems with torture. Its beauty is that once you concede there are circumstances in which torture might be justified, morally and legally… you are on the other side of the line. You’ve joined the torture crowd. To paraphrase [George W.] Bush, you’ve joined the evildoers.” Dean calls it “a bogus argument, a rhetorical device. It is seductively simple, and compellingly logical. But it is also pure fantasy.” The likelihood of such conditions are extremely remote, Dean writes, on the order of a giant meteor striking the Earth. Dean will cite Luban’s arguments as counters to the scenario. Luban writes, “[T]here are certain situations so monstrous that the idea that the processes of moral rationality could yield an answer in them is insane… to spend time thinking what one would decide if one were in such a situation is also insane, if not actually frivolous.” Luban notes that Senator John McCain (R-AZ), himself a victim of torture during the Vietnam War (see October 1, 2005 and November 21, 2005), “has said that ultimately the debate is over who we are. We will never figure that out until we stop talking about ticking bombs, and stop playing games with words.” [Dean, 2006, pp. 165]

Biskupic of Wisconsin investigates allegations that a travel firm used its influence with Governor Jim Doyle (D-WI) to improperly land a government contract (see October 19, 2005). Doyle denies any involvement with the affair and refuses to reopen bidding on the contract, saying the contract with Adelman Travel was awarded properly. Doyle also refuses to return $20,000 in donations from Adelman CEO Craig Adelman and board member Mitchell Fromstein, a decision Jay Heck of the liberal organization Common Cause says is a mistake: “You should always return money that’s in question because the longer you hang onto it, the worse it’s going to be.” Heck says transparency proposals by Doyle’s Republican opponents, Milwaukee County Executive Scott Walker (R-WI) and US Representative Mark Green (R-WI), would be of no real use. Furthermore, Heck notes, both Walker and Green have taken money from special interests along with Doyle. “All of them are taking money that at some point will compromise public policy because they have to raise so much of it and it almost all comes from special interests and it all comes with strings attached,” he says. Green accepted almost $54,000 in donations from health care insurers and pharmaceutical interests before voting for a controversial, industry-supported Medicare prescription drug benefit in 2003. Senator John McCain (R-AZ), an ardent opponent of torture by US officials (see November 21, 2005), continues to press an amendment to a $440 billion defense appropriations bill that prohibits cruel, inhuman, and degrading treatment of prisoners held in US captivity (see July 24, 2005 and After). The bill also posits the US Army Field Manual as the uniform standard for interrogations by any Defense Department personnel. The Field Manual is being revised, and Pentagon sources have claimed the revisions will include a section on the importance of following the Geneva Conventions. The amendment is facing stiff opposition from the White House, which asserts that it would encroach on the power of the president as the commander in chief, and would threaten national security by reducing the ability of military interrogators to obtain critical intelligence from prisoners. On the floor of the Senate, McCain reads a letter from former Secretary of State Colin Powell, who had opposed Vice President Cheney on the issue of torture. Powell writes: “Our troops need to hear from Congress. The world will note that America is making a clear statement with respect to the expected future behavior of our soldiers.” McCain himself calls the White House’s legal theories on torture “strange,” and warns that enemies could use America’s justifications of torture as justifications for the torture of US captives. “We are Americans and we hold ourselves to humane standards of treatment of people no matter how evil or terrible they may be,” he says. Terrorists “don’t deserve our sympathy. But this isn’t about who they are. This is about who we are. These are the values that distinguish us from our enemies.” The White House continues to oppose the amendment. President Bush threatens to veto the entire bill, and Cheney circulates pro-torture talking points to friendly Congressional Republicans. Cheney, with CIA Director Porter Goss in tow, asks McCain to exempt CIA officials from the anti-torture amendment at the discretion of the president; McCain refuses. McCain is bolstered by a letter signed by over two dozen retired generals urging Congress to pass the amendment, including Powell and former Joint Chiefs chairman General John Shalikashvili. The amendment passes the Senate 90 to nine. However, the House leadership, steered by Speaker Dennis Hastert (R-IL), refuses to allow the amendment into the House version by refusing to let the House vote on it at all. [Source: ThinkProgress.org]Fox News analyst Dan Senor, the former spokesman for the Coalition Provisional Authority in Iraq [White House, 10/1/2006; Salon, 5/10/2008] , writes an article for the neoconservative magazine Weekly Standard about the upcoming trial of captured Iraqi ruler Saddam Hussein. Senor writes that the trial will provide “a peek into the depths of human evil and, embarrassingly, if incidentally, into the concurrent indifference of Western nations to Iraqi suffering. Thus far, the accountability of Nuremberg, the Hague, Rwanda, and Sierra Leone has eluded Arab-Muslim leaders. This is about to change.” Senor also says that part of Hussein’s trial strategy will be to attempt to create sympathy for his “humiliation” that will translate into “a spike in the insurgency…” He notes that “an increase in violence is anticipated by Commanding General George Casey too.” [Weekly Standard, 10/2/2005] According to Pentagon documents released as part of the New York Times investigation into the Pentagon propaganda operation surrounding Iraq (see May 9, 2008), Senor routinely asks the advice of Pentagon public relations official Larry Di Rita about what he should say on his television broadcasts, and submits articles such as this to Di Rita for editing directions. During a roundtable discussion on ABC’s This Week, host George Stephanopoulos says, “[A] source close to this told me this week, that President Bush and Vice President Cheney were actually involved in some of these discussions” about disclosing CIA case officer Valerie Plame Wilson’s name to reporters (see July 14, 2003). Congressional Republicans jump-start the process to renew the 1965 Voting Rights Act (VRA—see August 6, 1965 and June 29, 1989) in what media and political observers believe is an effort to outflank Democrats, who are traditionally the most staunch supporters of the bill. Key portions of the bill are set to expire in 2007, including Section 5, which requires that states, districts, and other locales with a history of racial discrimination in their electoral processes get Justice Department approval before making any changes to voting procedures. Section 5 is intended to ensure that minorities are not disenfranchised due to their race. Observers believe Republicans want to avoid a showdown over the bill in light of the upcoming midterm elections in 2006. In 1982, the Reagan administration fought Congressional Democrats over an expansion of the law, and Republicans want to make sure that scenario does not play itself out again as the midterm elections approach. Republicans also want to reach out to African-American voters, traditionally a strong Democratic voting bloc. Representative John Lewis (D-GA), a veteran of the civil rights struggle, says, “I’m not surprised at all” that Republicans want to renew the VRA and reach out to black voters. “The Republicans are reaching out to the African-American voters.… They want to make a dent with the black electorate, take some of those voters away from the Democratic side.” Lewis intends to insert language into the renewal bill that would invalidate a recent Georgia law requiring photo identification for prospective voters, a requirement he and many others say would discriminate against the poor and the elderly. Representative James Sensenbrenner (R-WI) broke with recent Republican tradition by calling on Congress to renew Section 5 and other portions of the VRA at the NAACP’s annual convention in July. “I am here to tell you publicly what I have told others privately, including the head of the Congressional Black Caucus, Rep. Mel Watt,” Sensenbrenner told the assemblage. “During this Congress we are going to extend the Voting Rights Act. We cannot let discriminatory practices of the past resurface to threaten future gains. The Voting Rights Act must continue to exist—and exist in its current form.” Sensenbrenner said at the convention that House Speaker Dennis Hastert (R-IL) considers renewal of the VRA “high on his list of issues the House will address this Congress.” A representative for Senate Majority Leader Bill Frist (R-TN) says Frist is “fired up” over renewal of Section 5. Only a few months ago, Bush appeals court nominee William Pryor, a Republican from Alabama, called Section 5 “an affront to federalism and an expensive burden that has far outlived its usefulness,” a controversial characterization that Senator Saxby Chambliss (R-GA) and other Republicans defended. In May, Attorney General Alberto Gonzales suggested that the Bush administration is not fully behind reauthorization of Section 5. Political observers say that Democrats intend to use any further Republican opposition to the VRA to claim that Republicans are insensitive to black voters, even as senior Republican strategists like Republican National Committee Chairman Ken Mehlman say they want the party to appeal to that demographic. Mehlman told the NAACP convention in July that Republican leaders had tried over the past 40 years “to benefit politically from racial polarization.” He then said, “We were wrong” to do so. On October 6, 2005, the FBI warns of al-Qaeda subway bombings in New York City. It is alleged that a terror plot will be put into motion “on or about October 9, 2005.” A counterterrorism official states that the warning is unnecessary: “There was no there there.” [Rolling Stone, 9/21/2006 ] It is later confirmed that New York City authorities had been aware of the threat for at least three days and had responded accordingly. Local TV station WNBC had been asked by federal authorities to hold the story back. [MSNBC, 6/4/2007] Meanwhile, Bush’s nomination of Harriet Miers to the Supreme Court is failing (see October 3-27, 2005). [Rolling Stone, 9/21/2006 ]
In a speech, President Bush lists ten terrorist plots the US has supposedly foiled since 9/11, as well as five “casings and infiltrations.” Here are the plots, exactly as they are described in a White House press release, rearranged into a rough chronological order:
West Coast Airliner Plot - In mid-2002 the US disrupted a plot to attack targets on the West Coast of the United States using hijacked airplanes. The plotters included at least one major operational planner involved in planning the events of 9/11.
Jose Padilla Plot - In May 2002 the US disrupted a plot that involved blowing up apartment buildings in the United States. One of the plotters, Jose Padilla, also discussed the possibility of using a “dirty bomb” in the US.
2002 Straits of Hormuz Plot - In 2002 the US and partners disrupted a plot to attack ships transiting the Straits of Hormuz.
2002 Arabian Gulf Shipping Plot - In late 2002 and 2003 the US and a partner nation disrupted a plot by al-Qaeda operatives to attack ships in the Arabian Gulf.
2003 Karachi Plot - In the spring of 2003 the US and a partner disrupted a plot to attack Westerners at several targets in Karachi, Pakistan.
East Coast Airliner Plot - In mid-2003 the US and a partner disrupted a plot to attack targets on the East Coast of the United States using hijacked commercial airplanes.
2003 Tourist Site Plot - In 2003 the US and a partner nation disrupted a plot to attack a tourist site outside the United States.
Heathrow Airport Plot - In 2003 the US and several partners disrupted a plot to attack Heathrow Airport using hijacked commercial airliners. The planning for this attack was undertaken by a major 9/11 operational figure.
2004 UK Plot - In the spring of 2004 the US and partners, using a combination of law enforcement and intelligence resources, disrupted a plot to conduct large-scale bombings in [Britain].
2004 [British] Urban Targets Plot - In mid-2004 the US and partners disrupted a plot that involved urban targets in [Britain]. These plots involved using explosives against a variety of sites.

2001 Tasking - In 2001, al-Qaeda sent an individual to facilitate post-September 11 attacks in the US. US law enforcement authorities arrested the individual.
2003 Tasking - In 2003, an individual was tasked by an al-Qaeda leader to conduct reconnaissance on populated areas in the US.
Gas Station Tasking - In approximately 2003, an individual was tasked to collect targeting information on US gas stations and their support mechanisms on behalf of a senior al-Qaeda planner.
Iyman Faris and the Brooklyn Bridge - In 2003, and in conjunction with a partner nation, the US government arrested and prosecuted Iyman Faris, who was exploring the destruction of the Brooklyn Bridge in New York. Faris ultimately pleaded guilty to providing material support to al-Qaeda and is now in a federal correctional institution.
US Government & Tourist Sites Tasking - In 2003 and 2004, an individual was tasked by al-Qaeda to case important US Government and tourist targets within the United States. [White House, 10/6/2005]
However, later in the month the Washington Post publishes a story questioning the importance of most of these plots. The article states that the plot list “has confused counterterrorism experts and officials, who say they cannot distinguish between the importance of some incidents on the list and others that were left off. Intelligence officials who spoke on the condition of anonymity said the White House overstated the gravity of the plots by saying that they had been foiled, when most were far from ready to be executed. Others noted that the nation’s color-coded threat index was not raised from yellow, or ‘elevated’ risk of attack, to orange, or ‘high’ risk, for most of the time covered by the incidents on the list.” An anonymous former CIA counterterrorism official tells the Post that Bush made it “sound like well-hatched plans… I don’t think they fall into that category.” Another anonymous counterterrorism official says, “We don’t know how they came to the conclusions they came to… It’s safe to say that most of the [intelligence] community doesn’t think [the list is] worth very much.” [Washington Post, 10/23/2005]
The Fourth Circuit Court of Appeals rules that President Bush, as commander in chief, can continue to hold Jose Padilla (see June 9, 2002), a US citizen arrested on US soil (see June 8, 2002), indefinitely as an enemy combatant. Padilla is to be treated the same as an American captured on a foreign battlefield (see June 28, 2004). The majority ruling is written by Judge J. Michael Luttig, often thought of as a potential Bush Supreme Court nominee. Luttig rules there is “no difference in principle between [Yaser Esam] Hamdi (see June 28, 2004) and Padilla.” Bush’s “powers include the power to detain identified and committed enemies such as Padilla, who associated with al-Qaeda and the Taliban regime, and who entered the United States for the avowed purpose of further prosecuting [terrorism] by attacking American citizens and targets on our own soil.” Luttig ignores the fact that Padilla has never been charged, much less convicted, of any crime. When the Bush administration later charges Padilla as an ordinary criminal—and does not charge him with with any of the terrorist activities it had long alleged he had committed—many administration critics will conclude that, just as in the Hamdi case, the administration had used inflammatory rhetoric and baseless charges to obtain a judicial decision it wanted (see October 10, 2004). When Luttig learns of the administration’s actions, he will issue a supplementary opinion excoriating the White House (see December 21, 2005). [Savage, 2007, pp. 200]
New York Times reporter Judith Miller testifies for a second time to the grand jury investigating the Plame Wilson identity leak. In light of this and her earlier testimony (see September 30, 2005), federal judge Thomas Hogan lifts the contempt order he had previously issued (see October 7, 2004). Miller testifies about her notes on her discussions with Lewis “Scooter” Libby, the chief of staff for Vice President Dick Cheney (October 7, 2005). She testifies that she most likely met with Libby on June 23, 2003 (see June 23, 2003) only after prosecutors show her Secret Service logs that indicate she met with him in the Executive Office Building. She had failed to testify about that meeting in her previous testimony, and, when pressed by prosecutors, insisted that she could not remember that specific meeting. Miller’s lawyer, Robert Bennett, tells a reporter that today’s testimony “corrected” her earlier statements to the grand jury regarding the June 23 meeting. He adds, “We went back on the second occasion to provide those additional notes that were found, and correct the grand jury testimony reflecting on the June 23 meeting,” and says Miller’s testimony is now “correct, complete, and accurate.” Miller testifies today, as she did on September 30, that Libby disclosed Valerie Plame Wilson’s CIA status to her during discussions they had in June and July 2003, contradicting Libby’s own statements (see March 5, 2004 and March 24, 2004). Times editor Bill Keller says that the Times will “write the most thorough story we can of her entanglement with the White House leak investigation.” [New York Times, 10/12/2005; National Journal, 10/20/2005]
In an op-ed, Washington Post columnist Richard Cohen pleads with special prosecutor Patrick Fitzgerald to terminate his investigation of the Plame Wilson identity leak. “The best thing Patrick Fitzgerald could do for his country is get out of Washington, return to Chicago, and prosecute some real criminals,” Cohen writes. Fitzgerald, Cohen asserts, has accomplished nothing besides jailing New York Times reporter Judith Miller (see July 6, 2005) and “repeatedly haul[ing] this or that administration high official before a grand jury, investigating a crime that probably wasn’t one in the first place but that now, as is often the case, might have metastasized into some sort of coverup—but, again, of nothing much.” Cohen advises Fitzgerald to “[g]o home, Pat.” He says that for administration officials, the investigation is “[n]ot nice,” but is an example of Washington business as usual. “This is rarely considered a crime,” Cohen writes. Perhaps the outing of Valerie Plame Wilson, a clandestine CIA agent, “might technically be one,” but Cohen writes that “it was not the intent of anyone to out a CIA agent and have her assassinated (which happened once) but to assassinate the character of her husband. This is an entirely different thing. She got hit by a ricochet.” Cohen writes that Fitzgerald may be considering indicting White House officials, not for outing Plame Wilson, but for related crimes, perhaps disclosing secrets or on some sort of conspiracy charges. “Whatever the case, I pray Fitzgerald is not going to reach for an indictment or, after so much tumult, merely fold his tent, not telling us, among other things, whether Miller is the martyr to a free press that I and others believe she is or whether, as some lefty critics hiss, she’s a double-dealing grandstander, in the manner of some of her accusers.” Cohen says that the larger issue is “control of information,” and explains: “If anything good comes out of the Iraq war, it has to be a realization that bad things can happen to good people when the administration—any administration—is in sole control of knowledge and those who know the truth are afraid to speak up. This—this creepy silence—will be the consequence of dusting off rarely used statutes to still the tongues of leakers and intimidate the press in its pursuit of truth, fame, and choice restaurant tables. Apres Miller comes moi.” Intimidating reporters would have more far-reaching effects than bringing what Cohen calls “trivial charges” to court. “Please, Mr. Fitzgerald,” Cohen concludes, “there’s so much crime in Washington already. Don’t commit another.” [Washington Post, 10/13/2005]
Representative Darrell Issa (R-CA) writes a letter to the US Attorney for Southern California, Carol Lam (see November 8, 2002), complaining about her “apparent instance of discretionary non-prosecution of criminal illegal aliens.” He says that Lam should immediately reverse her decision not to prosecute Alfredo Gonzales Garcia (also recorded as “Alfredo Garcia-Gonzalez”), a repeat offender currently in the custody of the Border Patrol; he writes, “Criminal alien repeat offenders pose a significant danger to our citizens and must be dealt with more severely than a 24-hour detention and release.” He continues: “Your office has established an appalling record of refusal to prosecute even the worst criminal alien offenders.… Every time one of these criminals is released, our communities become more dangerous.” [US House of Representatives, 10/13/2005 ; US Department of Justice, 3/23/2007 ; US House of Representatives, Committee on the Judiciary, 4/13/2007 ] Issa and his fellow Republicans have long pressured Lam to prosecute more immigrant cases (see February 2, 2004, July 30, 2004, November 4, 2004 - (February 2005), (December 30, 2004), and September 23, 2005). Issa has also accused Lam, apparently without proof, of having a policy of not prosecuting “immigration ‘mules,’” apparently referring to immigrant “smugglers,” sometimes called “coyotes,” who help immigrants illegally cross the border from Mexico into the US. In June 2005, Lam denied having such a policy, but did note that “it is not physically possible to prosecute every alien (or coyote) who is arrested” and therefore her office “must focus its prosecutorial resources on those aliens who pose the greatest danger to the United States by their presence.” At the same time, Assistant Attorney General William Moschella wrote in response: “The Southern District of California (SDCA) does not have a policy against prosecuting coyotes, publicly stated or otherwise. Nor does any other district. In fact, SDCA has aggressively prosecuted coyotes for years, with an increasing number of cases in each year since 2001.” [US House of Representatives, Committee on the Judiciary, 4/13/2007 ]

[Washington Post, 10/15/2005; Washington Post, 7/3/2007] Rove amends and clarifies his earlier testimony, most notably his failure to remember outing Plame Wilson to Time reporter Matthew Cooper (see 11:00 a.m. July 11, 2003). Special prosecutor Patrick Fitzgerald spends a large portion of Rove’s session focusing on the omission. In earlier testimony, Rove attempted to claim that he had only a “hazy recollection” of hearing Plame Wilson’s name (see October 15, 2004) before reading Robert Novak’s column which publicly outed her as a CIA agent (see July 14, 2003). He now testifies that he informed Cooper of her status as a CIA agent days before the article appeared, and his memory apparently failed him during his earlier statements to the grand jury. Rove testifies that his recollection was prompted by the discovery of an e-mail message to Stephen Hadley, then the deputy national security adviser, that he wrote after talking to Cooper (see March 1, 2004). [National Journal, 10/7/2005; New York Times, 10/15/2005] He insists that he never identified Plame Wilson by her name, but “merely” as the wife of former ambassador Joseph Wilson, and did not intentionally reveal her as a covert CIA official because he did not know of her clandestine status. [Washington Post, 10/15/2005] He says he may have learned of Plame Wilson’s CIA identity from fellow White House official Lewis Libby, and says that both he and Libby learned of her CIA employment status from reporters. He says someone else outside the White House also told him of Plame Wilson’s identity, but he cannot remember who that was. [Washington Post, 10/20/2005] Previously, Rove insisted that he learned of Plame Wilson’s identity from reporters, and not the other way around, as many reporters and others have already testified. Rove has said that one of the reporters who told him that Plame Wilson was a CIA official was Novak, a statement Novak has contradicted (see October 7, 2003, February 5, 2004, and September 14, 2004). Rove also testified that he never told Cooper Plame Wilson’s name, but merely identified her as the wife of former ambassador Joseph Wilson. [Associated Press, 7/15/2005]
Rove's Testimony No Distraction, White House Officials Claim - White House spokesman Scott McClellan says Rove’s testimony has not distracted the administration from its usual affairs: “[W]hile there are other things going on, the White House doesn’t have time to let those things distract from the important work at hand.” [New York Times, 10/15/2005] White House chief of staff Andrew Card concurs. “Well, obviously we’re all human beings and we know that there are external activities that impact the environment you’re working in,” he says. “It is something that is there, but it is something that we don’t talk about because it would be inappropriate.… I haven’t found anyone that is distracted because of the ongoing investigation, but we all know that it’s taking place and we’re all working to cooperate with the investigators.” [Washington Post, 10/15/2005]
Lawyer: Rove 'Always Honest' with FBI, Jury, President - Rove’s lawyer, Robert Luskin, says that his client “has always attempted to be honest and fully forthcoming” to anyone “he has spoken to about this matter, whether that be the special prosecutor or the president of the United States. My client would not hide anything, because he has nothing to hide. It would not be to his benefit to do so.” Previously, Rove had failed to disclose his discussion with Cooper to either the FBI or to President Bush (see After September 26, 2003). [National Journal, 10/7/2005] “The special counsel has not advised Mr. Rove that he is a target of the investigation and affirmed that he has made no decision concerning charges.” [Washington Post, 10/15/2005]
Fitzgerald Mulling Criminal Charges against Rove - Sources close to the Fitzgerald investigation say Rove’s statements to Bush and to the FBI are at the heart of the decision whether or not to charge him with making false statements to investigators, or with obstruction of justice. Lying to the president could in itself be worthy of charges. Law professor Rory Little, a former federal prosecutor and assistant attorney general in the Clinton administration, says: “The president is the top law enforcement official of the executive branch. It is a crime to make a false statement to a federal agent. If the president was asking in that capacity, and the statement was purposely false, then you might have a violation of law.” However, if Bush had discussed the matter with Rove in a more informal capacity, then, Little says, a case for making false statements to a federal agent would be more difficult to prove. Law professor Randall Eliason says that if Rove deliberately lied to the president, a prosecutor could construe the lie as an “overt act… in furtherance of a criminal plan.” Law professor Stephen Gillers notes: “Misleading the president, other officials of the executive branch, or even the FBI might not, in and of themselves, constitute criminal acts. But a prosecutor investigating other crimes—such as obstruction of justice or perjury—might use evidence of any such deception to establish criminal intent. And a lack of candor might also negate a claim of good faith or inadvertent error in providing misleading information to prosecutors.” [National Journal, 10/7/2005]

The New York Times again finds itself apologizing for its failures in covering the outing of Valerie Plame Wilson and its handling, or lack of handling, of the newspaper’s star reporter, Judith Miller, who recently testified as to her knowledge of the matter (see September 30, 2005). It also admits that much of Miller’s prewar reporting on Iraq was “totally wrong.” Although the paper’s publisher, Arthur Sulzberger, and its executive editor, Bill Keller, supported Miller’s decision to go to jail rather than reveal the source of her knowledge about Plame Wilson’s CIA identity (see July 6, 2005), neither knew many details of Miller’s conversations with her source, former White House aide Lewis “Scooter” Libby. Neither knew, for example, that Miller’s claim of not learning Plame Wilson’s identity from Libby was undermined by her own notes. Ultimately, both Sulzberger and Keller left most of the decisions on how to handle the situation to Miller herself. “This car had her hand on the wheel because she was the one at risk,” says Sulzberger. While Miller continues to portray her decision to go to jail as one rooted in principle, critics say that she and the Times were not protecting a whistleblower, but an administration source bent on crushing dissent. Asked what she regretted about the Times’s handling of the matter, managing editor Jill Abramson says, “The entire thing.”
'I Got It Totally Wrong' - Many in the newsroom and in the editorial staff believed that Miller’s prewar articles on Iraq’s WMD—articles that have long been proven to be based largely on false information from unreliable Iraqi defectors (see December 20, 2001, September 18, 2002, March 19-20, 2003, July 25, 2003, and Autumn 2003)—unfairly advanced the administration’s case for war. Miller operated with a level of autonomy other reporters found unusual and distressing, especially since many of them believed her reporting verged on administration propaganda. Investigative editor Douglas Frantz recalls that Miller once called herself “Miss Run Amok”; when he asked her what she meant, she replied, “I can do whatever I want.” Miller now admits her reports were largely specious. “WMD—I got it totally wrong,” she says. “The analysts, the experts, and the journalists who covered them—we were all wrong. If your sources are wrong, you are wrong. I did the best job that I could.”
Not a Clear-Cut Decision to Fight - Keller says: “I wish it had been a clear-cut whistle-blower case. I wish it had been a reporter who came with less public baggage.” Times reporter Todd Purdom says: “Everyone admires our paper’s willingness to stand behind us and our work, but most people I talk to have been troubled and puzzled by Judy’s seeming ability to operate outside of conventional reportorial channels and managerial controls. Partly because of that, many people have worried about whether this was the proper fight to fight.” For her part, Miller says she intends to take some time off and perhaps write a book about her ordeal. She says she wants to get back into investigative reporting, and continue to cover “the same thing I’ve always covered—threats to our country.” [New York Times, 10/16/2005]
Criticism of Miller, Times - The next day, columnist Norman Solomon will write, “It now seems that Miller functioned with more accountability to US military intelligence officials than to New York Times editors.” Solomon also notes that in her July 8, 2003 meeting with White House official Lewis Libby (see 8:30 a.m. July 8, 2003), Miller expressed frustration at the government’s refusal to allow her “to discuss with editors some of the more sensitive information about Iraq.” Solomon writes: “There’s nothing wrong with this picture if Judith Miller is an intelligence operative for the US government. But if she’s supposed to be a journalist, this is a preposterous situation—and the fact that the New York Times has tolerated it tells us a lot about that newspaper.” Solomon also notes that Miller’s claim of “analysts, the experts, and the journalists who covered them” were “all wrong” about Iraqi WMD is itself wrong. “Some very experienced weapons inspectors—including [the chief of the International Atomic Energy Agency] Mohamed ElBaradei, [former chief UN weapons inspector] Hans Blix, and [former UN weapons inspector] Scott Ritter—challenged key assertions from the White House,” he writes. “Well before the invasion, many other analysts also disputed various aspects of the US government’s claims about WMDs in Iraq.… Meanwhile journalists at some British newspapers, including The Independent and The Guardian, raised tough questions that were virtually ignored by mainstream US reporters in the Washington press corps.… [T]he Times did not ‘fall for misinformation’ as much as jump for it. The newspaper eagerly helped the administration portray deceptions as facts.” [CounterPunch, 10/17/2005] Liberal columnist and blogger Arianna Huffington provides a long list of reporters and publications who “didn’t get it wrong” on Iraqi WMD. She quotes reporter Joe Lauria, a veteran foreign affairs reporter who writes for the London Daily Mail, the Daily Telegraph, and the Boston Globe, who told her: “I didn’t get it wrong. And a lot of others who covered the lead up to the war didn’t get it wrong. Mostly because we weren’t just cozying up to Washington sources but had widened our reporting to what we were hearing from people like Mohamed ElBaradei and Hans Blix, and from sources in other countries, like Germany, France, and Russia. Miller had access to these voices, too, but ignored them. Our chief job as journalists is to challenge authority. Because an official says something might make it ‘official,’ but it doesn’t necessarily make it true.” [Huffington Post, 10/21/2005]

John Hannah, a senior aide to Vice President Dick Cheney, begins cooperating with the investigation into the exposure of CIA official Valerie Plame Wilson. Sources close to the investigation say that Hannah agreed to cooperate after learning that witnesses identified him as a co-conspirator in the Plame Wilson leak. Those sources say that Hannah has not been granted immunity from prosecution, but most likely has been offered a deal in exchange for information that could lead to indictments of any number of White House officials. Sources say that, in June 2003, Hannah and another Cheney aide, David Wurmser (see May 29, 2003), were ordered by their superiors in Cheney’s office to leak Plame Wilson’s name and CIA identity in an attempt to discredit her husband, war critic Joseph Wilson. [Raw Story, 10/19/2005; New York Times, 10/19/2005] Hannah helped pass along information about Plame Wilson’s CIA status from the State Department to Cheney (see May 29, 2003), and provided Cheney with a classified CIA report on the agency’s investigation into Iraq’s supposed attempt to procure uranium from Niger (see June 9, 2003).

[Source: Paid Content (.org)]Jacob Weisberg, a senior editor of Slate magazine, warns liberals that the possible prosecution of White House official Karl Rove and/or former White House aide Lewis Libby may not be cause for celebration. “Opponents of the Bush administration are anticipating vindication on various fronts—justice for their nemesis Karl Rove, repudiation of George W. Bush’s dishonest case for the Iraq war, a comeuppance for Chalabi-loving reporter Judith Miller of the New York Times, and even some payback for the excesses of independent counsels during the Clinton years,” he writes. Weisberg calls support for the potential prosecutions “self-destructive,” and explains: “Anyone who cares about civil liberties, freedom of information, or even just fair play should have been skeptical about [special prosecutor Patrick] Fitzgerald’s investigation from the start. Claiming a few conservative scalps might be satisfying, but they’ll come at a cost to principles liberals hold dear: the press’s right to find out, the government’s ability to disclose, and the public’s right to know.” Weisberg calls the law that is at the heart of the Plame Wilson investigation, the Intelligence Identities Protection Act (IIPA), “flawed,” and the entire Fitzgerald investigation “misbegotten.” The law is difficult to use for a conviction because it requires that prosecutors prove intent to do harm. “Under the First Amendment, we have a right to debate what is done in our name, even by secret agents,” Weisberg writes. “It may be impossible to criminalize malicious disclosure without hampering essential public debate.” After calling the White House “negligent” and “stupid” for revealing Plame Wilson’s CIA status, he says that no one has shown Rove, Libby, or any other official leaked her name with the intent of causing her or her career harm. Weisberg writes: “[A]fter two years of digging, no evidence has emerged that anyone who worked for Bush and talked to reporters about Plame… knew she was undercover. And as nasty as they might be, it’s not really thinkable that they would have known. You need a pretty low opinion of people in the White House to imagine they would knowingly foster the possible assassination of CIA assets in other countries for the sake of retaliation against someone who wrote an op-ed they didn’t like in the New York Times” (see July 6, 2003). The outing of Plame Wilson was “accidental,” Weisberg claims, part of the Bush administration’s attempts to defend itself against its failure to find WMD in Iraq. Weisberg calls Fitzgerald “relentless and ambitious,” implying that he is pursuing the case for the fulfillment of his personal ambition, and says that no evidence exists of anyone breaking any laws, whether it be the IIPA, statutes against perjury or conspiracy, obstruction of justice, or anything else. Fitzgerald will indict someone for something, Weisberg states, because not to do so would seem like he failed in his investigation. Fitzgerald is sure to bring what Weisberg calls “creative crap charges of his own devising” against someone, be it a White House official or a reporter. Weisberg concludes by calling Fitzgerald’s investigation “a disaster for freedom of the press and freedom of information.” [Slate, 10/18/2005]
David Wurmser, an aide to Vice President Dick Cheney, begins cooperating with the investigation into the exposure of Valerie Plame Wilson as a CIA agent. This follows the news that another Cheney aide, John Hannah, is also cooperating (see Before October 17, 2005). The news that Wurmser is cooperating comes from sources close to the investigation. He is expected to provide special counsel Patrick Fitzgerald with evidence that the leak of Plame Wilson’s identity was part of a coordinated effort to discredit her husband, war critic Joseph Wilson (see June 2003, June 3, 2003, June 11, 2003, June 12, 2003, June 19 or 20, 2003, July 6, 2003, July 6-10, 2003, July 7, 2003 or Shortly After, 8:45 a.m. July 7, 2003, 9:22 a.m. July 7, 2003, July 7-8, 2003, July 11, 2003, (July 11, 2003), July 12, 2003, July 12, 2003, July 18, 2003, October 1, 2003, April 5, 2006, and April 9, 2006). Wurmser is Cheney’s adviser on Middle East affairs, and formerly served as an assistant to then-Undersecretary of State John Bolton (see May 29, 2003). The sources say Wurmser is cooperating in order to negate potential criminal charges for his role in exposing Plame Wilson’s identity. Wurmser was a key member of the White House Iraq Group (WHIG—see August 2002), the propaganda group that operated primarily out of Cheney’s office. The sources say that in June 2003, Wurmser and Hannah were ordered by their superiors in Cheney’s office to leak Plame Wilson’s name and CIA identity in an attempt to discredit her husband, Joseph Wilson. In 2004, Wurmser was questioned by the FBI for his role in divulging classified national security information to Israel, an investigation that included Hannah and several prominent neoconservatives in the Defense Department. Wilson says: “John Hannah and David Wurmser, mid-level political appointees in the vice president’s office, have both been suggested as sources of the leak.… Mid-level officials, however, do not leak information without the authority from a higher level.” [Raw Story, 10/19/2005]
The Omega World Travel agency claims that it was improperly denied a $750,000 contract by the Wisconsin state government in favor of another firm with ties to Governor Jim Doyle (D-WI). The other firm, Adelman Travel, is owned by Craig Adelman, a major contributor to Doyle’s political campaign. Adelman and a member of the firm’s board of directors, Mitchell Fromstein, both donated $10,000—the maximum allowed under the law—to Doyle’s re-election campaign. Omega contends that the bidding process was rigged to favor Adelman Travel. State purchasing division supervisor Georgia Thompson (see 2001) says Omega and Adelman Travel were essentially tied as frontrunners during the bidding phase. Doyle denies any involvement in the selection of Adelman Travel as the state’s supplier of travel services. Doyle’s opponent for the 2006 gubernatorial race, Representative Mark Green (R-WI), says the affair has “cast a cloud on state government.” [Milwaukee Journal-Sentinel, 10/19/2005] Omega declined to formally contest the contract award. [Milwaukee Journal-Sentinel, 10/21/2005] Department of Administration Secretary Stephen Bablitch will say there is no evidence that Adelman Travel was awarded the contract improperly, and will note that the firm lost out on three of the four contracts it bid for. [Milwaukee Journal-Sentinel, 1/24/2006]
The White House continues to fight against the McCain anti-torture amendment (see October 1, 2005). Vice President Cheney and CIA Director Porter Goss meet privately with Senator John McCain (R-AZ), the primary sponsor of the amendment, for 45 minutes to push a change in the language that would exempt CIA interrogators from the amendment’s restrictions. In 2007, author and reporter Charlie Savage will write on the remarkable aspects of Cheney’s requests. For the first time, the CIA would be “clearly authorize[d] to engage in abusive interrogations. In effect, it would legalize the abuse of detainees in CIA prisons, a matter that had previously been a gray area at best.” McCain flatly rejects Cheney’s proposal, and later says: “I don’t see how you could possibly agree to legitimizing an agent of the government engaging in torture. No amendment at all would be better than that.” [Savage, 2007, pp. 220]
New York Times columnist Nicholas Kristof writes that the Fitzgerald investigation of the Plame Wilson identity leak is running the risk of moving too far, too fast, and may end up jailing Bush administration officials without good cause. Kristof cites two Republican-driven investigations from the 1990s—the “fanatical” Kenneth Starr investigation of former President Clinton and the “appalling” 10-year pursuit of former Housing Secretary Henry Cisneros—to warn that the Fitzgerald investigation, like those he cites from the 1990s, may be moving into murkier areas than originally warranted, i.e. the investigation into who leaked the name of a clandestine CIA agent. Special counsel Patrick Fitzgerald may be “considering mushier kinds of indictments,” Kristof writes, “for perjury, obstruction of justice, or revealing classified information. Sure, flat-out perjury must be punished. But if the evidence is more equivocal, then indictments would mark just the kind of overzealous breach of prosecutorial discretion that was a disgrace when Democrats were targeted. And it would be just as disgraceful if Republicans are the targets.” Kristof acknowledges that White House officials “behaved abominably in this affair,” and says, “the idea of a government official secretly using the news media… to attack former Ambassador Joseph Wilson [is] sleazy and outrageous. But a crime? I’m skeptical, even though there seems to have been a coordinated White House campaign against Mr. Wilson” (see October 1, 2003). “My guess is that the participants in a White House senior staff meeting discussed Mr. Wilson’s trip and the charges that the administration had knowingly broadcast false information about uranium in Niger—and then decided to take the offensive. The leak of Mrs. Wilson’s identity resulted from that offensive, but it may well have been negligence rather than vengeance.” Kristof doubts that anyone in the White House knew that Plame Wilson was an undercover agent, and believes that “some official spread the word of Mrs. Wilson’s work at the CIA to make her husband’s trip look like a nepotistic junket.” He calls such behavior “appalling,” and says that columnist Robert Novak “was absolutely wrong to print the disclosure” (see July 14, 2003). “But there’s also no need to exaggerate it,” he concludes. The entire Plame Wilson affair is an example of “backstabbing politics,” he writes, “but not… obvious criminality.” Therefore, Fitzgerald should be wary of handing down indictments, both in the interest of legal restraint and for fear that indicting “White House officials on vague charges of revealing classified information… will have a chilling effect on the reporting of national security issues.” [New York Times, 10/25/2005]
The grand jury hearing evidence in the Plame Wilson CIA leak investigation hears the summation of special counsel Patrick Fitzgerald. The final weeks of the jury’s tenure have been marked by what the Washington Post calls “a furious effort” by lawyers for White House political strategist Karl Rove to convince Fitzgerald that Rove should not be prosecuted for perjury. The press is unsure what criminal charges Fitzgerald may have asked the jury to bring, or whether he asked them to vote on possible indictments. The grand jury’s term is expiring, and observers believe Fitzgerald is reluctant to empanel a second grand jury to consider further evidence. Law professor Lori Shaw says this jury is well-versed and invested in the investigation. “You have to consider: They are not rookies at this anymore,” she says. “I have a feeling that by now this grand jury has a good idea of what crime, if any, occurred.” White House officials believe that either Rove or Lewis Libby, Vice President Dick Cheney’s chief of staff, and perhaps both of them, will face criminal charges. But the White House is downplaying the current status of the investigation. Press secretary Scott McClellan tells reporters, “We certainly are following developments in the news, but everybody’s got a lot of work to do.” And President Bush has tried to shift the public’s attention away from the investigation and onto what he calls his successful economic policies. [Washington Post, 10/27/2005] Two days later, the jury will indict Libby (see October 28, 2005).
The media learns that Vice President Dick Cheney and staffers from the Office of the Vice President (OVP) regularly interfered with the Senate Intelligence Committee’s 2004 report on the intelligence community’s failures to accurately assess Iraq’s WMD threat (see July 9, 2004). According to administration and Congressional sources, that interference was facilitated and encouraged by committee chairman Pat Roberts (R-KS). Cheney and the OVP members regularly intervened in the committee’s deliberations, and drastically limited the scope of the investigation.
Protecting the Bush Administration - Reporter Laura Rozen will later write, “In order to prevent the White House and the Office of the Vice President itself from ever coming under any Congressional oversight scrutiny, Cheney exerted ‘constant’ pressure on [Roberts] to stall an investigation into the Bush administration’s use of flawed intelligence on Iraq.” Cheney and the OVP also withheld key documents from the committee. Some of the withheld materials included portions of then-Secretary of State Colin Powell’s February 2003 address to the United Nations (see February 5, 2003) that were written by Cheney’s then-chief of staff, Lewis Libby, and documents that Libby used to make the administration’s case for war with Iraq. The OVP also withheld the Presidential Daily Briefing (PDB) documents: written intelligence summaries provided to President Bush by the CIA. The decision to withhold the documents was spearheaded by Cheney’s chief legal counsel and chief of staff David Addington. Much of the withheld material, and Cheney-OVP interference, was designed to keep the committee from looking into the Bush administration’s use of intelligence findings to promote the war. According to committee member John D. Rockefeller (D-WV), Cheney attended regular policy meetings in which he gave White House orders to Republican committee staffers. It is “not hearsay,” Rockefeller says, that Cheney pushed Roberts to, in reporter Jonathan Landay’s words, “drag out the probe of the administration’s use of prewar intelligence.” The committee chose to defer the second portion of its report, about the administration’s use of intelligence to propel the nation to war, until after the November 2004 elections. That portion of the report remains uncompleted.
Shifting the Blame to the White House - Reporter Murray Waas writes, “Had the withheld information been turned over, according to administration and Congressional sources, it likely would have shifted a portion of the blame away from the intelligence agencies to the Bush administration as to who was responsible for the erroneous information being presented to the American public, Congress, and the international community.” He continues: “When the [report] was made public, Bush, Cheney, and other administration officials cited it as proof that the administration acted in good faith on Iraq and relied on intelligence from the CIA and others that it did not know was flawed. But some Congressional sources say that had the committee received all the documents it requested from the White House the spotlight could have shifted to the heavy advocacy by Cheney’s office to go to war. Cheney had been the foremost administration advocate for war with Iraq, and Libby played a central staff role in coordinating the sale of the war to both the public and Congress.” [National Journal, 10/27/2005; Wilson, 2007, pp. 381]

Washington Post investigative reporter Bob Woodward slams ‘Plamegate’ special prosecutor Patrick Fitzgerald. In an interview on CNN’s Larry King Live, he calls Fitzgerald’s investigation “disgraceful.” When asked if he knew who might have leaked CIA agent Valerie Plame Wilson’s name to the press, Woodward claims—falsely—that he has no idea. “I wish I did have a bombshell,” he says. “I don’t even have a firecracker.” The leak, he says, is merely “gossip and chatter” of interest only to “a junkyard-dog prosecutor” like Fitzgerald who “goes everywhere and asks every question and turns over rocks and rocks under rocks and so forth.” Woodward also claims that the CIA’s assessment of the damage likely to have been done by the leak is “minimal.” Woodward says: “They did not have to pull anyone out undercover abroad. They didn’t have to resettle anyone. There was no physical danger to anyone, and there was just some embarrassment. So people have kind of compared—somebody was saying this was [similar to the cases of convicted spies] Aldrich Ames or Bob Hanssen, big spies. This didn’t cause damage.” Woodward is ignoring reports that the damage caused by the leak may well have been severe and widespread (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, and February 13, 2006); he also fails to note an upcoming report by his own newspaper that notes the CIA has not yet completed its assessment of the damage, but speculates as to just how severe the damage is believed to be (see October 29, 2005). [CNN, 10/27/2005; Media Matters, 10/31/2005; Media Matters, 11/16/2005; Time, 11/20/2005] Woodward does not mention that he is one of the reporters who was contacted by a Bush administration official about Plame Wilson being a CIA agent (see June 13, 2003). He has also withheld his knowledge of the case from Fitzgerald and his own editors (see November 16-17, 2005).
Washington Post columnist Michael Kinsley writes in the online magazine Slate that he finds the entire Niger-Plame-Libby issue “confusing” and incoherent. After mocking a variety of aspects of the case (“Niger, which is not Nigeria,” the “Pynchonesque… mysterious beauty” of the surname “Plame,” the forgettable blandness of the name Joe Wilson, and the nickname “Scooter,” or perhaps “Snooker” or “Snotty,” of accused leaker Lewis Libby), and portraying the entire issue as the plot of a forgettable film noir or perhaps a Shakespeare knockoff, he calls the “whole prosecution nuts.” [Slate, 10/28/2005]
Representative Henry Waxman (D-CA), the ranking member of the House Oversight Committee, writes a letter to committee chairman Tom Davis (D-VA), asking that the committee open an investigation into the Plame Wilson identity leak. Waxman’s letter will not receive a response. Davis has already ignored four similar letters from Waxman (see September 29, 2003, October 8, 2003, December 11, 2003, and July 11, 2005). In light of the indictment of Lewis “Scooter” Libby (see October 28, 2005), the Center for American Progress (CAP) puts out an analysis of Libby’s role as Vice President Dick Cheney’s chief of staff, and the impact Libby has had on Bush administration policies. Libby, a powerful and influential neoconservative, “has been one of the most important men pulling the levers behind the Bush administration,” the article finds. “From the very beginning of the administration, Libby has essentially been Dick Cheney’s Dick Cheney.” But, the article goes on to note: “[w]hat few have realized at this historic moment is that for the past four and a half years, Libby has been ‘scooting’ from scandal to scandal. Libby has been at center stage for the other major national security scandals of the Bush administration, including the Iraq intelligence debacle, the secret meetings about Halliburton contracts, and doubtless others we have not heard of yet. It was Libby—along with Paul Wolfowitz, Doug Feith, and a handful of other top aides at the Pentagon and White House—who convinced the president that the US should go to war in Iraq. It was Libby who pushed Cheney to publicly argue that Saddam Hussein had ties to al-Qaeda and 9/11. It was also Libby who prodded former Secretary of State Colin Powell to include specious reports about an alleged meeting between 9/11 terrorist Mohamed Atta and an Iraqi intelligence official in Powell’s February 2003 speech to the United Nations” (see February 5, 2003). Libby co-authored the controversial Defense Planning Guidance document of 1988 (see February 18, 1992) that called on the US to essentially transform itself into an aggressive empire, using its military to stretch its power around the world. “This Planning Guidance document went a long way toward endearing Libby to Cheney,” the CAP article reads. There is also evidence that Libby helped steer no-bid Iraqi reconstruction contracts to Cheney’s former firm, Halliburton. The article concludes, “Given the depth of his influence in shaping the White House agenda over the past four and a half years, losing Libby today is not only a huge blow to the vice president, but to the entire Bush administration.” [Center for American Progress, 10/28/2005]
Washington Post reporter Bob Woodward is dismissive of the indictment of White House official Lewis Libby (see October 28, 2005), saying, “I don’t know how this is about the buildup to the war, the Valerie Plame Wilson issue.” He dismisses the entire Plame Wilson investigation as mere White House gossiping. Woodward has his own peripheral involvement in Plame Wilson’s outing, which he keeps secret for years (see June 13, 2003) and November 16-17, 2005); according to author Frank Rich, that makes him a prime example of journalistic hypocrisy. Rich will add that it is hard to fathom how any journalist could come to such a conclusion. Rich will write: “If one assumes, as Woodward apparently did, against mounting evidence to the contrary, that the White House acted in good faith purveying its claims of imminent doomsday and pre-9/11 Qaeda-Saddam collaboration, then there’s no White House wrongdoing that needs covering up. So why would anyone in the administration try to do something nasty to silence a whistle-blower like Joseph Wilson? Where’s the story?” [Rich, 2006, pp. 191]

Five Counts of Obstruction, Two Counts of Perjury - Libby is indicted on five counts of obstruction of justice and two counts of perjury. [US District Court for the District of Columbia, 10/28/2005 ; MSNBC, 2/21/2007] Though the original investigation was of the Plame Wilson leak, Fitzgerald says it is important to understand that Libby’s crimes, though not the prime focus of the initial investigation, should be prosecuted as well. “Investigators do not set out to investigate the statute, they set out to gather the facts,” he says. The indictment does not charge Libby with knowingly disclosing the identity of a covert agent. [New York Times, 10/28/2005]
Confirms that CIA Agent's Status Classified; Important to National Security - Fitzgerald confirms that the fact of Plame Wilson’s employment at the CIA was in and of itself classified information, and not to be shared to the media or the public. He says: “The fact that she was a CIA officer was not well known, for her protection or for the benefit of all us. It’s important that a CIA officer’s identity be protected, that it be protected not just for the officer, but for the nation’s security.… [T]he damage wasn’t to one person. It wasn’t just Valerie Wilson. It was done to all of us” (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, and February 13, 2006). Libby Lied about Knowledge of Plame Wilson's Status, Indictment Charges - The indictment charges that Libby lied when he claimed that he learned of Plame Wilson’s CIA status from NBC reporter Tim Russert (see November 24, 2003, March 5, 2004, March 24, 2004, and August 7, 2004). Instead, the indictment charges, Libby learned about Plame Wilson and her possible role in sending her husband, former ambassador Joseph Wilson, to Niger to investigate claims of Iraqi attempts to buy uranium (see February 21, 2002-March 4, 2002) from a number of people, including an undersecretary of state (see June 10, 2003), a CIA officer who regularly briefed him on national security issues (see 2:00 p.m. June 11, 2003), an unidentified “senior CIA officer,” and from his superior, Cheney (see (June 12, 2003)). In his turn, Libby shared that information with several officials in the Office of the Vice President, including Cheney’s senior counsel David Addington (see July 8, 2003), Cheney’s national security adviser John Hannah (see May 29, 2003), and Cheney’s press secretary at the time, Cathie Martin (who may have actually informed Libby—see 5:27 p.m. June 11, 2003). “In fact, Mr. Libby was the first official known to have told a reporter when he talked to Judith Miller in June of 2003 about Valerie Wilson” (see June 23, 2003), Fitzgerald says. “[T]o be frank, Mr. Libby gave the FBI a compelling story,” he adds. “It would be a compelling story that will lead the FBI to go away if only it were true. Sought Information on Plame Wilson's CIA Status - The indictment also charges that Libby sought information from the CIA and the State Department about Plame Wilson’s CIA status, and tried to determine whether she had been responsible for sending her husband to Niger. According to the indictment, Libby asked David Addington, the chief counsel to Cheney, “in sum and substance, what paperwork there would be at the CIA if an employee’s spouse undertook an overseas trip.” The court papers do not say what action, if any, Addington may have taken in response to Libby’s request. Discussed with Multiple Officials before Leaking to Reporters - In a press conference, Fitzgerald walks reporters and listeners through the indictment: from Libby’s learning of Plame Wilson’s identity from State Department and CIA sources and from Cheney, through his discussing it with at least three White House officials, all before the supposed “disclosure” from Russert. Libby subsequently lied to the FBI and to Fitzgerald’s grand jury about those discussions with government officials and again with Miller and Time reporter Matthew Cooper. “[H]e lied about it afterwards,” Fitzgerald says, “under oath and repeatedly.… [A]nyone who would go into a grand jury and lie, obstruct, and impede the investigation has committed a serious crime.” [New York Times, 10/28/2005]
Leak Seriously Jeopardized National Security - Fitzgerald tells reporters that the leaking of a CIA officer’s identity is a serious breach of national security. “This is a very serious matter and compromising national security information is a very serious matter,” he says. “But the need to get to the bottom of what happened and whether national security was compromised by inadvertence, by recklessness, by maliciousness is extremely important.” Fitzgerald continues: “At a time when we need our spy agencies to have people work there, I think just the notion that someone’s identity could be compromised lightly… [discourages] our ability to recruit people and say, ‘Come work for us… come be trained… come work anonymously here or wherever else, go do jobs for the benefit of the country for which people will not thank you.” Senator John D. Rockefeller (D-WV), the ranking Democrat on the Senate Intelligence Committee, says: “Revealing the identity of a covert agent is the type of leak that gets people killed. Not only does it end the person’s career… it puts that person in grave personal danger as well as their colleagues and all the people they have had contact with.” [New York Times, 10/28/2005; National Journal, 10/30/2005]
Charges Are Serious, Not 'Technicalities' - Responding to a question about Republican charges that Libby is being charged as a “technicality,” and Fitzgerald “overreached” his authority in filing the indictment, Fitzgerald says: “That talking point won’t fly. If you’re doing a national security investigation, if you’re trying to find out who compromised the identity of a CIA officer and you go before a grand jury and if the charges are proven… that the chief of staff to the vice president went before a federal grand jury and lied under oath repeatedly and fabricated a story about how he learned this information, how he passed it on, and we prove obstruction of justice, perjury, and false statements to the FBI, that is a very, very serious matter.… [T]he truth is the engine of our judicial system. And if you compromise the truth, the whole process is lost.… Any notion that anyone might have that there’s a different standard for a high official, that this is somehow singling out obstruction of justice and perjury, is upside down.… If these facts are true, if we were to walk away from this and not charge obstruction of justice and perjury, we might as well just hand in our jobs. Because our jobs, the criminal justice system, is to make sure people tell us the truth. And when it’s a high-level official and a very sensitive investigation, it is a very, very serious matter that no one should take lightly.” [New York Times, 10/28/2005]
Explanation for Delay in Filing Indicitment - Fitzgerald gives one reason for the delay in filing the indictment against Libby. When asked why he went to such lengths to compel the testimony of reporters such as Miller (see September 30, 2005) and Cooper (see July 13, 2005), Fitzgerald replies that the rights of the accused are paramount in his mind. The testimony of Miller, Cooper, and other journalists could bolster the case against Libby, or could help exonerate him. The possibility that he might charge someone, only to learn later that one of the journalists who had declined to testify had information to clear the person, was something that “frightens me,” Fitzgerald says. “I think the only way you can do an investigation like this is to hear all eyewitnesses.” [New York Times, 10/28/2005; National Journal, 11/12/2005]
No Charges against Cheney - Asked whether the investigation found evidence of criminal acts by Cheney, Fitzgerald answers: “We make no allegation that the vice president committed any criminal act. We make no allegation that any other people who provided or discussed with Mr. Libby committed any criminal act. But as to any person you asked me a question about other than Mr. Libby, I’m not going to comment on anything.” Fitzgerald refuses to comment on whether White House political strategist Karl Rove or anyone else will be named as co-conspirators, charged, or even named in court. Hours after the Patrick Fitzgerald press conference announcing the indictment of Lewis Libby (see October 28, 2005), NBC reporter Andrea Mitchell tells a viewing audience on MSNBC’s Hardball that the exposure of Valerie Plame Wilson, the CIA official whose exposure as a covert agent triggered the investigation that led to Libby’s indictment, did no real damage to US intelligence interests. Mitchell does not cite any sources in her claim. She says: “I think the prosecutor [Fitzgerald] made a very broad claim, whether you buy it or not, that the disclosure of any CIA officer’s identity is a threat to our national security, that we are at a stage in our country where we need to recruit people, we need to guarantee that they will have anonymity, and that you cannot recruit people to work in these difficult jobs, nor can you be sure that by disclosing their identity that you are not putting them in jeopardy. I happen to have been told that the actual damage assessment as to whether people were put in jeopardy on this case did not indicate that there was real damage in this specific instance.” It is possible that Mitchell sources her claim from a very similar claim made the night before by Washington Post reporter Bob Woodward (see October 27, 2005). [Jane Hamsher, 11/29/2005] Two years before, Mitchell told a CNBC audience that “everybody knew” Plame Wilson was a covert official, a claim she was later forced to retract (see October 3, 2003). Shortly after Mitchell’s Hardball claim, MSNBC commentator Tucker Carlson writes, “In fact, as NBC’s Andrea Mitchell has reported, an internal CIA investigation found that Plame’s outing caused no discernable damage to anyone.” [MSNBC, 11/18/2005] A 2003 CIA assessment (see Before September 16, 2003) and an October 2005 analysis by the Washington Post (see October 29, 2005) both determined that Plame Wilson’s exposure caused “severe damage” to the US intelligence community, particularly in the Middle East.
In an op-ed, the Wall Street Journal’s editorial staff accuses special counsel Patrick Fitzgerald of “criminalizing politics” in his investigation of the Plame Wilson leak. Fitzgerald’s investigation, the editorial reads, has taken two years, cost millions of dollars, jailed a reporter (see July 6, 2005), “and preoccupied some of the White House’s senior officials.” The investigation has culminated in the indictment of former White House official Lewis Libby (see October 28, 2005), not for leaking Valerie Plame Wilson’s identity to the press, but for what the Journal calls “contradictions between his testimony and the testimony of two or three reporters about what he told them, when he told them, and what words he used.” The Journal writes that there is no evidence, at least to the public’s knowledge, that Libby lied to anyone, be it the FBI (see October 14, 2003 and November 26, 2003), the grand jury (see March 5, 2004 and March 24, 2004), or anyone else. Nowhere has anyone alleged a motive for Libby’s alleged perjury, the Journal states (see June 2003, June 3, 2003, June 11, 2003, June 12, 2003, June 19 or 20, 2003, July 6, 2003, July 6-10, 2003, July 7, 2003 or Shortly After, 8:45 a.m. July 7, 2003, 9:22 a.m. July 7, 2003, July 7-8, 2003, July 11, 2003, (July 11, 2003), July 12, 2003, July 12, 2003, July 18, 2003, October 1, 2003, April 5, 2006, and April 9, 2006). And, the Journal notes, Libby was not a source for the column that actually outed Plame Wilson as a CIA official. The Journal questions the existence of any White House “conspiracy to silence administration critics,” and if there was, it writes, “it was more daft than deft.” Instead, the Journal writes, the Libby indictment “amounts to an allegation that one official lied about what he knew about an underlying ‘crime’ that wasn’t committed.” Fitzgerald is merely involving himself in what the Journal calls “a policy dispute between an elected administration and critics of the president’s approach to the war on terror, who included parts of the permanent bureaucracy of the State Department and CIA.” [Wall Street Journal, 10/29/2005]
After former White House official Lewis Libby’s indictment (see October 28, 2005), he retains the services of three of Washington’s most powerful attorneys: Theodore Wells, William Jeffress, and John Cline. [Boston Globe, 2/26/2006] (Cline will not officially join the defense team until mid-November.) [San Francisco Chronicle, 11/22/2005] Wells, who has successfully defended other government officials from criminal charges, is “an excellent choice,” according to criminal defense attorney Jeralyn Merritt. Jeffress is a partner at Baker Botts, the law firm headed by former Secretary of State James Baker. [Jeralyn Merritt, 11/3/2005] Cline is an expert on classified government documents; according to former CIA case officer Valerie Plame Wilson, he is “presumably hired to help the defense figure out how to ‘graymail’ the government, that is, force the government to choose between prosecuting an employee for serious crimes or preserving national security secrets.” Stanford University criminal law expert Robert Weisberg says of Cline’s addition to the team: “This is about as subtle as a sledgehammer to the government. This suggests they are going to use a very concerted and aggressive strategy.”
Legal Defense Fund Headed by GOP Fundraiser - Shortly after the indictment, Libby’s legal defense fund is created, headed by former GOP finance chief Melvin Sembler, a Florida real estate tycoon. Sembler is a highly successful fundraiser for Republican candidates, and is a close friend of Vice President Dick Cheney. Lobbyist and former Justice Department spokeswoman Barbara Comstock, a close friend of Libby’s, recruited Sembler to head the fund. According to Comstock, Sembler “holds Scooter [Libby] in high esteem as many members of the committee have. We’re confident that Scooter will be exonerated. He has declared he’s innocent.” [Tampa Tribune, 11/24/2005] In her 2007 book Fair Game, Plame Wilson will note, “Sembler, ironically enough, was President George W. Bush’s ambassador to Italy when the embassy in Rome first received the forged yellowcake documents, whose contents precipitated [Joseph Wilson]‘s trip to Niger and Libby’s legal odyssey.” [Wilson, 2007, pp. 289-290] The first contribution to the defense fund comes from Richard Carlson, a former US ambassador, the former president of the Corporation of Public Broadcasting, and the father of conservative pundit Tucker Carlson. “He spent years in government service,” Carlson will later say of Libby, whom Carlson calls a friend. He “hasn’t made a lot of dough.” The fund will soon raise over $2 million, in part through a Web site, scooterlibby.com (see February 21, 2006). Comstock and former Cheney communications director Mary Matalin (see July 10, 2003 and January 23, 2004) are deeply involved in the fund. The fund’s board of directors and advisers is studded with prominent Republicans, including former Republican presidential candidates Steve Forbes and Jack Kemp; former senator, lobbyist, and actor Fred Thompson; former senator Alan Simpson; former Education Secretary William Bennett; Princeton professor Bernard Lewis, one of the driving intellectual forces behind the invasion and occupation of Iraq; former UN ambassador Jeane Kirkpatrick; former Energy Secretary Spencer Abraham; former Clinton Middle East envoy Dennis Ross; and former CIA Director James Woolsey, another neoconservative ally of Libby’s. [New York Times, 11/18/2005; San Francisco Chronicle, 11/22/2005; Boston Globe, 2/26/2006] Howard Leach and Wayne Berman, two top fundraisers for the 2004 Bush-Cheney presidential campaign, are also part of the defense fund. Comstock tells a New York Times reporter that because both Ross and Woolsey served in the Clinton administration, the Libby defense fund is a bipartisan entity. According to a United Press International (UPI) report, special counsel Patrick Fitzgerald has sought and received documentation on the Iraq-Niger forgeries (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003) from the Italian government. UPI reports, “Fitzgerald’s team has been given the full, and as yet unpublished report of the Italian parliamentary inquiry into the affair, which started when an Italian journalist obtained documents that appeared to show officials of the government of Niger helping to supply the Iraqi regime of Saddam Hussein with [y]ellowcake uranium.” (In November, that parliamentary report will be shown not to exist—see July 2005.) According to reporter Jason Leopold, the information about the Iraq-Niger documents being provided to Fitzgerald comes from NATO sources. After White House official Lewis Libby is indicted (see October 28, 2005), Washington Post editor and reporter Bob Woodward “realizes” that he was a recipient of the information that Valerie Plame Wilson was a CIA official (see June 13, 2003). Woodward has been scathing in his criticism of the Plame Wilson identity leak investigation, and staunch in his support of the journalists who outed Plame Wilson in their reporting (see December 1, 2004, July 7, 2005, July 11, 2005, July 17, 2005, July 31, 2005, October 27, 2005, and October 28, 2005). According to Woodward’s own recollections, he was asked by Post executive editor Leonard Downie Jr. to help report on the status of the investigation into the leak. Woodward will say that upon listening to special counsel Patrick Fitzgerald tell reporters that Libby was the first White House official to reveal Plame Wilson’s name to a reporter (see June 23, 2003), he realizes that Fitzgerald is misinformed. Instead, Woodward had received that information from another Bush administration source 10 days before Libby. (Woodward’s source was then-Deputy Secretary of State Richard Armitage, a fact that Woodward does not disclose to the media, and is not publicly revealed for nearly six months—see March 14, 2006). Woodward quickly telephones his source (Armitage), and will tell another reporter: “I said it was clear to me that the source had told me [about Wilson’s wife] in mid-June, and this person could check his or her records and see that it was mid-June. My source said he or she had no alternative but to go to the prosecutor. I said, ‘If you do, am I released?’” Woodward is referring to the confidentiality agreement between the two. The source agrees, but only for purposes of discussing it with Fitzgerald, not for publication. Woodward later says he tried twice, once in 2004 and once earlier in 2005, to persuade Armitage to remove the confidentiality restriction, but Armitage refused to budge. Woodward informs Fitzgerald of his contact with Armitage, as does Armitage. While Armitage has spoken to the FBI about his role in leaking Plame Wilson’s identity (see October 2, 2003), and to the grand jury investigating the leak (in which he failed to divulge his contact with Woodward—see September 22, 2004), Woodward has not spoken to Fitzgerald until now, though his name appears on numerous White House telephone and visitors’ logs during the critical period of June and July 2003. Woodward will say he is surprised not to have been contacted by Fitzgerald, and, in contrast to his earlier criticisms of Fitzgerald, will call him “incredibly sensitive to what we do. He didn’t infringe on my other reporting, which frankly surprised me. He said, ‘This is what I need, I don’t need any more.’” [Time, 11/18/2005; Washington Post, 8/29/2006] Woodward will soon give a deposition to Fitzgerald, and will write about his role in the leak for the Post (see November 14, 2005).
Terry Moran, ABC News’s chief White House correspondent, tells ABC host George Stephanopoulos that he believes White House press secretary Scott McClellan unwittingly lied to reporters when he asserted that White House staffers Karl Rove (see September 16, 2003, September 27, 2003, September 29, 2003, and September 29, 2003) and Lewis “Scooter” Libby (see October 4, 2003 and October 4, 2003) knew nothing of the Valerie Plame Wilson identity leak. “He was telling falsehoods right at us over and over unwittingly,” Moran says. Asked if McClellan knew he was lying, Moran replies: “No. And he signaled he wants to tell us the story,” referring to McClellan’s comments that he would like to be able to discuss his public support of Rove and Libby. Stephanopoulos asks, “[Y]ou say he didn’t know it, so that means Karl Rove lied to him?” “Yes,” Moran answers, “yes.” Moran notes that the White House will most likely do nothing except continue to “stonewall” and deny involvement: “My sense it right now they’ll kick this down the road. They’ll say it’s a continuing case and we’re going to kick it down the road.” [McClellan, 2008, pp. 265-266]
The Washington Post prints an article by reporter Barton Gellman about the intelligence leaks from the White House that led to the outing of CIA official Valerie Plame Wilson. The article examines the question of whether Lewis Libby, Vice President Dick Cheney’s former chief of staff, obstructed the FBI investigation into Plame Wilson’s exposure in order to protect Cheney. [Washington Post, 10/30/2005] According to journalist and blogger Joshua Micah Marshall, the Post deleted a key portion of Gellman’s story shortly after it appeared on the Post’s Web site (the edited version is what makes it into print). The deleted portion noted that on July 12, 2003, Cheney told Libby “to alert reporters of an attack launched that morning on [former ambassador Joseph] Wilson’s credibility by Fleischer, according to a well-placed source” (see July 12, 2003 and 3:20 a.m. July 12, 2003). [Joshua Micah Marshall, 10/30/2005] A criminal lawyer who blogs under the moniker “Anonymous Liberal” speculates that the Post may have removed the reference to Fleischer because Fleischer was a source for Post reporter Walter Pincus. Pincus is identified in Gellman’s article as receiving information from an unidentified White House source who, like Libby, attacked Wilson and implied that he was sent to Niger by his wife (see February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005). The Wall Street Journal prints an editorial by former Bush Solicitor General Theodore Olson lambasting the Plame Wilson identity leak investigation and the indictment of former White House aide Lewis Libby (see October 28, 2005), and criticizing the use of the Independent Counsel Law to investigate the Plame Wilson identity leak. The Journal does not inform its readers of Olson’s participation in using the Independent Counsel Law to bring articles of impeachment against former President Clinton. Olson calls the investigation a “spectacle,” questions special counsel Patrick Fitzgerald’s impartiality, and says the entire Plame Wilson-Libby investigation is another example of “special prosecutor syndrome,” a politically motivated investigation run amok. Olson writes that he does not believe Libby is guilty of perjury because “I know him to be an honest, conscientious man who has given a large part of his life to public service.” Any misstatements Libby may have made to investigators (see October 14, 2003, November 26, 2003, March 5, 2004, and March 24, 2004) must have been inadvertent failures of memory and not deliberate lies. Moreover, Olson asserts, Libby had nothing to do with exposing Valerie Plame Wilson as a CIA official (see

Syndicated conservative columnist Cal Thomas writes that because the Valerie Plame Wilson identity leak investigation is nothing more than a witch hunt to tar Bush administration officials over the war in Iraq, the special prosecutor law under which Patrick Fitzgerald is conducting his investigation should be abolished. According to Thomas, President Clinton was lauded by the media, and his investigator, special prosecutor Kenneth Starr, was universally portrayed as a “sex maniac with a political agenda” who was hounding a “decent man” over a legal, if morally questionable, sexual liaison. “Thus, Clinton’s lies under oath about his affair with Monica Lewinsky were not a big deal.” The media is giving “saturation coverage” to the Libby indictments, Thomas claims, while it gave “short shrift” to Clinton administration indictments such as then-Agriculture Secretary Michael Espy and HUD Secretary Henry Cisneros. The situation is different with accused perjurer Lewis Libby, Thomas writes (see October 28, 2005). Fitzgerald is being praised by media pundits as “an apolitical straight-shooter who is the definition of integrity” (see December 30, 2003, January 1, 2004, July 11, 2005, July 17, 2005, October 13, 2005, October 18, 2005, October 25, 2005, October 27, 2005, and October 29, 2005), and is running a fair and non-partisan investigation into crimes committed by Libby and perhaps other White House officials. According to Thomas, Fitzgerald is doing little more than working for administration critics who didn’t get their way over Iraq: “[t]hose who lost the policy battle over going to war are now fighting a rear-guard action in an attempt to damage the Bush administration and win the political war in time for the 2006 Congressional elections and certainly by the 2008 presidential contest.” Thomas says that since the Independent Counsel Law was passed in 1978 in the wake of the Watergate scandal, it has brought few convictions and cost taxpayers an inordinate amount of money. “Enough Democrats and Republicans have been forced to run this gauntlet that perhaps a truly bipartisan solution can be found to end it,” Thomas concludes. “That Libby’s indictments are not about policy, but about who remembers what and when, ought to be the final straw in this ridiculous process.” [Town Hall (.com), 10/31/2005]
Craig Cobb. [Source: The Liberty Lamp (.com)]Avowed white supremacist Craig Cobb attempts to disrupt the viewing of the body of Rosa Parks, the celebrated African-American civil rights figure, who is lying in state in the US Capitol Rotunda. Over 50,000 people wait in line to view her body. Cobb accosts many of them while they stand outside the Rotunda; many later recall being horrified and offended by the racist epithets stated by the stringy-haired man in horn-rimmed glasses carrying a videocamera. Cobb apparently delights in offending and angering the people in line, telling them: “Rosa Parks was a sh_tskin communist. I’m here to celebrate her death.” He is eventually escorted away by Secret Service agents. Cobb is a neo-Nazi who later founds Podblanc, an Internet-based videosharing Web site (see Late 2005 or Early 2006 and After). [Southern Poverty Law Center, 6/2009]
Some time between when al-Qaeda leader Ibn al-Shaykh al-Libi is moved to a prison in Mauritania in November 2005 (see November 2005) and September 2006 when most imprisoned al-Qaeda leaders are transferred to Guantanamo (see September 2-3, 2006), al-Libi disappears from known US custody. Al-Libi was captured in late 2001 and confessed that the Iraqi government helped train al-Qaeda in chemical and biological weapons (see January 2002 and After). In 2004, he recanted his confession amid allegations that he was brutally tortured, and the CIA later determined his Iraq allegations were untrue (see February 14, 2004). In May 2007, a group of Democratic Congresspeople will write President Bush, asking if al-Libi was tortured and/or renditioned to Egypt to be tortured, and also asking, “Where is al-Libi today?” Human-rights groups and others suspect the Bush administration is hiding al-Libi and concealing key information about him because of the potential political and legal ramifications about his torture, as well as his false confession that helped lead to war with Iraq. While the White House has yet to respond to queries about al-Libi, Newsweek will later claim that al-Libi, a Libyan, has been quietly returned to Libya and is being secretly imprisoned there. He is reportedly extremely ill with tuberculosis and diabetes. It is said the Libyan government has kept silent about holding al-Libi as a favor to the Bush administration, to help avoid more public scrutiny about him. [Newsweek, 5/29/2007]

The Henry Jackson Society (HJS), whose motto is “Project for Democratic Geopolitics,” advocates an interventionist foreign policy to spread democracy. Its supporters include many influential personalities known for their support of the Iraq War, as well as their pro-American and pro-Israel stance. Richard Dearlove, the former head of MI6, is one of the signatories of its manifesto. In the days after Michael Steele (R-MD), an African-American, announced his candidacy for governor of Maryland, allegations have resurfaced that in 2002 he was “pelted” with Oreo cookies by Democrats at a political debate (see September 26, 2002 and After); if true, such actions would constitute a significant racial slur. However, reporting of the incident has fallen into question, and Steele himself recently denied being hit by cookies during the debate, though he did say he saw Oreos on the stage near him: “I’ve never claimed that I was hit, no. The one or two that I saw at my feet were there. I just happened to look down and see them.” Eyewitness accounts compiled by the Baltimore Sun show that the allegations are questionable at best; moreover, the Sun reports, accounts of the incident by Republican gubernatorial candidate Robert Ehrlich, Ehrlich’s communications director Paul Schurick, and Steele himself, dramatically contradict each other. Progressive media watchdog organization Media Matters compares the different accounts of the incident, and concludes that the story has grown from an almost-baseless “partisan talking point” into “a ‘fact’ reported by the media” over the last three years. Media Matters notes that several newspapers, including the Chicago Sun-Times, the Washington Post, and the Washington Times, have recently reported the incident as factual, with the Times writing that Steele was “pelt[ed] with Oreo cookies” among the “racially tinged attacks” directed at him by his Democratic opponent in 2002. Chicago Sun-Times columnist Mary Mitchell writes: “Steele has been subjected to the worst racial slurs imaginable. At one debate, a group of black people pelted the stage with Oreos.” Between October 31 and November 16, the Washington Times asserts the incident as fact three times in its editorial pages, and twice in its news reporting. The Weekly Standard reports it three times. Fox News talk show host Sean Hannity twice asserts it as fact on his broadcast, as does one of his guests, National Review editor Rich Lowry. Deroy Murdock, another National Review contributor, asserts it as fact in one of his columns. Washington Post metro editor Marc Fisher cites it in an online chat. Mitchell cites it in the Chicago Sun-Times. The conservative American Spectator cites it as fact once. Syndicated columnist Gregory Kane cites it as fact once. The National Newspaper Publishers Association News Service editor in chief George Curry states it as fact on National Public Radio, as does the host of the NPR program, Ed Gordon. The Investors Business Daily cites it as fact in an editorial. MSNBC’s Tucker Carlson cites it as fact on the air. The Associated Press cites it as fact in an article. Media Matters also notes that the story resurfaced briefly during the August 2004 Republican National Convention, with the Baltimore Sun reporting that Steele and Ehrlich “still talk” about the incident, and the Washington Post reporting it as fact. Joseph Galloway. [Source: National Public Radio]Veteran war correspondent Joseph Galloway, a stern critic of the Iraq policies of the administration and the Pentagon, journeys to the Pentagon for what he believes to be a one-on-one lunch with Defense Secretary Donald Rumsfeld. The reporter is surprised to find that Rumsfeld has invited four colleagues along to assist him with Galloway: Peter Pace, the chairman of the Joint Chiefs of Staff; Richard Cody, the vice chief of staff of the Army; the director of the Joint Staff, Walter Sharp; and the Assistant Secretary of Defense for Public Affairs, Larry Di Rita. The highlights of the lunch discussion, which is marked by a series of digressions and tangential conversations, are as follows:
Rumsfeld tells Galloway, “I’m not hearing anything like the things you are writing about.” Galloway responds that he often found that people in positions of such power and influence rarely receive the unvarnished truth. Rumsfeld retorts: “Oh, I know that but I talk to lots of soldiers all the time. Why, I have given over 600 town hall meetings and anyone can ask me anything.”
Rumsfeld then shifts gears to visit one of Galloway’s favorite topics: the question of whether the US Army is broken. Far from being in poor shape, Rumsfeld asserts, the Army is “light years better than it was four years ago.” Galloway counters that Rumsfeld’s strategies are nonsensical if they result in Army and Marine soldiers being sent in endless forays down the same highways to die by roadside bombs. The US is playing to the insurgency’s strong suit, Galloway argues. Rumsfeld agrees, and says he has instructed the US commander in Iraq, General George Casey, to shift the focus from patrolling to “standing up” the Iraqi defense forces. He has told Iraq’s leaders that the US is losing the stomach for the ever-growing casualty count, “and they understand that and agree with it.” Galloway parries Rumsfeld’s talk with a question about the Army sending bill collectors after wounded soldiers who lost limbs in a bombing, or were “overpaid” for combat duty and benefits. Rumsfeld blames the Pentagon’s computer system, and says the problem is being addressed.
Rumsfeld agrees with one of Galloway’s columns that lambasted the Pentagon for doing enemy body counts. “We are NOT going to do body counts,” Rumsfeld asserts. Galloway retorts that the Pentagon is indeed doing body counts and releasing them, and has been doing so for a year. If you don’t want to do body counts, Galloway says, then stop doing them.
Throughout the conversation, Rumsfeld jots down notes on what he considers to be valid points or criticisms. Galloway writes: “Others at the table winced. They had visions of a fresh shower of the secretary’s famous ‘snowflakes,’ memos demanding answers or action or both.” Before Galloway leaves, Rumsfeld shows him some memorabilia and tells him, “I want you to know that I love soldiers and I care about soldiers. All of us here do.” Galloway replies that concern for the troops and their welfare and safety are his only purpose, “and I intend to keep kicking your butt regularly to make sure you stay focused on that goal.” As Galloway writes, “He grinned and said: ‘That’s all right. Vice President Cheney appears at the weekly Republican senatorial luncheon in the Capitol and speaks against the McCain anti-torture amendment (see October 1, 2005 and October 20, 2005). He argues that CIA interrogations of high-value al-Qaeda prisoners have produced valuable information, and the president needs the power and flexibility to use torture against prisoners in order to fight terrorism and protect the nation. Senator John McCain (R-AZ), the primary sponsor of the amendment, counters Cheney’s arguments during the same luncheon, arguing that the idea of the US torturing prisoners damages its standing with its international allies. [Savage, 2007, pp. 220] The next day, the Washington Post will publish an expose of the CIA’s secret prison network (see November 2-18, 2005), causing a firestorm of criticism and sparking a former Bush administration official to say that the “philosophical guidance” behind the torture of prisoners comes directly from Cheney’s office (see November 3, 2005).
The White House continues to battle a Senate-approved amendment against torture (see October 1, 2005). Vice President Cheney, the administration’s strongest voice in favor of torture, gathers a group of Republican senators and gives what is later described as an impassioned plea to let the CIA torture when necessary. President Bush needs that option, Cheney argues, and a prohibition against torture may eventually cost the nation “thousands of lives.” He cites alleged 9/11 mastermind Khalid Shaikh Mohammed as one of torture’s success stories (see February 29 or March 1, 2003, Shortly After February 29 or March 1, 2003, and June 16, 2004). Cheney fails to tell the gathering that the US has overseen the torture of Mohammed’s wife and children, and that Mohammed was told that if he didn’t cooperate, his children would be subjected to further abuse (see After September 11, 2002). He also fails to tell them that the information elicited from Mohammed was considered unreliable (see Summer 2003), and that many of Mohammed’s interrogators felt that torture merely hardened his resistance. During the meeting, John McCain (R-AZ), the author of the anti-torture amendment, tells Cheney, “This is killing us around the world.” On November 4, the Republican House leadership postpones a vote on the amendment when it realizes the amendment will pass overwhelmingly. The press learns that UN Ambassador John Bolton was contacted in May 2003 by Lewis Libby to find out who sent former ambassador Joseph Wilson on a fact-finding mission to Niger (see February 21, 2002-March 4, 2002 and May 29, 2003). Bolton was the undersecretary of state for arms control and international security affairs when Libby contacted him. The progressive news Web site Raw Story learns of the Bolton contact from lawyers involved in the investigation of the Plame Wilson identity leak, and from documents posted on the investigation’s Web site. The lawyers say that two former Libby aides, John Hannah and David Wurmser, informed special counsel Patrick Fitzgerald of Libby’s inquiry to Bolton (see Before October 17, 2005 and Before October 19, 2005). At the time, Wurmser was on loan from Bolton’s office and serving as a Middle Eastern affairs aide to Vice President Dick Cheney and Libby. Both Hannah and Wurmser have been cooperating with Fitzgerald’s investigation, the lawyers say. MSNBC has reported that Bolton testified before the Plame Wilson grand jury. Wurmser, the lawyers say, has been cooperating for fear that he would be charged for his role in leaking Valerie Plame Wilson’s CIA identity; Hannah began cooperating after learning that he had been identified by witnesses as a co-conspirator in the leak. Raw Story writes: “It is unclear whether Bolton played any other role in the Plame outing, but his connection to the Iraq uranium claims certainly gave him a motive to discredit Wilson, who had called into question the veracity of the Niger documents. A probe by the State Department inspector general revealed that Bolton’s office was responsible for the placement of the Niger uranium claims in the State Department’s December 2002 ‘fact sheet’ on Iraq’s WMD program.” The lawyers say it is doubtful that the information Hannah and Wurmser have provided will ever be made public, but their information was crucial to Fitzgerald’s investigation because it allowed him “to put together a timeline that showed how various governmental agencies knew about Plame [Wilson]‘s covert CIA status.” [Raw Story, 11/2/2005]
Retired Army General Paul Vallely, a military analyst employed by Fox News (see Early 2002 and Beyond, Late September 2003, April 14-16, 2006, and April 18, 2006), says that former ambassador Joseph Wilson revealed his wife’s status as a CIA official over a year before she was exposed by conservative columnist Robert Novak (see July 14, 2003). Vallely’s claims are published by WorldNetDaily (WND), an online conservative news site, after Vallely makes the claims on an ABC Radio talk show hosted by conservative commentator and blogger John Batchelor. Fox News has described Vallely as an expert on psychological warfare (see April 21, 2003). Vallely says Wilson openly discussed his wife, Valerie Plame Wilson, as a CIA official between three and five times in 2002, while the two waited to appear on various Fox News broadcasts. Both Vallely and Wilson served as analysts for Fox News during the US’s run-up to the March 2003 invasion of Iraq. Vallely says the first time Wilson discussed his wife’s CIA status was in the spring of 2002. “He was rather open about his wife working at the CIA,” Vallely says. “He was a total self promoter,” Vallely continues. “I don’t know if it was out of insecurity, to make him feel important, but he’s created so much turmoil, he needs to be investigated and put under oath.” Vallely also says that several acquaintances of his at the CIA have said Wilson routinely introduced his wife as a CIA official at Washington cocktail parties and social events. “That was pretty common knowledge,” he says. “She’s been out there on the Washington scene many years.” If she were a covert agent, Valley says (see Fall 1992 - 1996), “he would not have paraded her around as he did.” Vallely concludes, “This whole thing has become the biggest non-story I know, and all created by Joe Wilson.” Conservative lawyer Victoria Toensing agrees that Plame Wilson is most likely not a covert agent for the agency. WND does not report Wilson’s response to Vallely’s charges, and in several critical references to a Vanity Fair interview given by the Wilsons (see January 2004) the blog misidentifies the date of the interview publication as 2005, not 2004. CIA Confirmed Plame Wilson's Covert Status - The CIA has repeatedly confirmed Plame Wilson as a covert official, and many observers both inside and outside the agency have noted the extensive damage caused by her exposure (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, and February 13, 2006).
Fox News, Conservative Blogs Report Claims - Three days after Vallely’s claims appear on WND, Fox News reports Vallely’s statements. [Fox News, 11/8/2005] And a day after the WND article, Batchelor announces on prominent conservative blog RedState that another analyst will confirm Vallely’s claims. Batchelor says that on November 7, Vallely and retired Air Force General Thomas McInerney will “repeat and expand upon Vallely’s memory that Joe Wilson more than once in 2002 in the green room at Fox New Channel in Washington, DC, boasted about his wife the ‘CIA desk officer.’ McInerney has the same memory and more, since both he and Vallely were on FNC between 150 and 200 times in 2002 each.” [John Batchelor, 11/6/2005]
Wilson Demands Retraction, Counters Claim - Wilson’s attorney, Christopher Wolf, e-mails both Vallely and WND demanding that they retract Vallely’s statements, writing that “the claim that Ambassador Wilson revealed to you or to anyone that his wife worked for the CIA is patently false.” In the e-mail, Wolf includes a message Wilson sent him: “This is slanderous. I never appeared on [TV] before at least July 2002 and only saw him maybe twice in the green room at Fox. Vallely is a retired general and this is a bald faced lie. Can we sue? This is not he said/he said, since I never laid eyes on him till several months after he alleges I spoke to him about my wife.”
Vallely Modifies Original Claim, Others Refuse to Confirm - Progressive media watchdog organization Media Matters notes that in subsequent days, Vallely modifies his original claims, backing down to claim that Wilson revealed his wife’s CIA status on “only one occasion,” which “probably was in that summer, early fall” of 2002. And promises that two other military analysts, retired generals McInerney and Barry McCaffrey, will back up his claims go unfulfilled, as neither is willing to publicly state that Wilson ever spoke to them about his wife. Vallely later says he has not spoken to the FBI about his claims, and tells conservative talk show host Sean Hannity that he waited two years to make the claims because “I figured Joe Wilson would self-destruct at some point in time.” He tells Hannity that he has been “upset” by Wilson’s opposition to the Bush administration’s strategy in Iraq. [Media Matters, 11/9/2005] Batchelor’s promise that fellow conservative commentator Victor Davis Hansen will also confirm the claim also goes unfulfilled. Fox News Schedule Shows Vallely, Wilson Never Appeared Together - Progressive blogger John Amato and former CIA agent Larry Johnson pore through the Fox News schedule for the time period Vallely cites—the spring of 2002—and find that Vallely and Wilson never appeared together during that time. Johnson writes: “They were never in the studio on the same day, much less the same program. Vallely is lying or maybe having a senior moment.” [John Amato, 11/7/2005]

[Source: Associated Press]Lewis Libby, the former chief of staff to Vice President Dick Cheney, pleads not guilty to five felony indictments stemming from the Plame Wilson CIA identity leak (see October 28, 2005). “With respect, your honor, I plead not guilty,” Libby says. Libby’s trial will be presided over by Judge Reggie Walton of the US District Court of the District of Columbia; Libby is primarily represented by lawyers Ted Wells and William Jeffress, both known for winning acquittals in high-profile white-collar criminal cases. Wells recently won acquittals for former Agriculture Secretary Michael Espy and former Labor Secretary Raymond Donovan, while Jeffress is a partner at Baker Botts, where former Secretary of State James Baker, a close friend of the Bush family, is a senior partner. Libby waives his right to a speedy trial; it will take his legal team three months to obtain security clearances and to examine classified information the prosecution must provide to the defense. His lawyers are expected to demand that a large amount of classified information regarding Valerie Plame Wilson’s covert CIA status be turned over to them. Jeffress warns reporters that there could be numerous First Amendment “issues” that may produce “protracted litigation” and delay the case, obviously referring to the expected testimony of a number of journalists. Libby’s next court date is February 3, 2006. [Associated Press, 11/3/2005; Washington Post, 11/3/2005] Libby is apparently in good spirits during the proceedings, smiling and even laughing with his lawyers. [Salon, 11/3/2005] Outside the courthouse, Wells tells reporters: “In pleading not guilty, [Libby] has declared to the world that he is innocent. He has declared that intends to fight the charges in the indictment, and he has declared that he wants to clear his good name.” He adds that Libby welcomes a jury trial. Libby does not speak to reporters. [CNN, 11/3/2005] Former prosecutor Michael Madigan, now a well-known defense lawyer, says Wells and Jeffress are excellent choices to represent Libby, but notes that they are joining the case with “one hand tied behind their back” because of what has already transpired in the investigation. They enter the case “with Libby having given two different statements to the FBI and testifying twice to the grand jury, in which he contradicts three reporters and four or five of his friends in the administration,” Madigan says. “If I was entering the case, I would not be really happy to have that situation.… It would be difficult now to say that you didn’t recall certain things when you’ve already testified that you did remember them.” [Washington Post, 11/3/2005]
Victoria Toensing, a former deputy attorney general in the Reagan administration, writes a guest editorial for the Wall Street Journal that demands the Plame Wilson investigation, as it stands, be closed. Instead, she says, the CIA should be investigated for causing Valerie Plame Wilson’s identity to become public knowledge. Toensing blames the CIA’s “bizarre conduct” for Plame Wilson’s exposure. The CIA is responsible for Plame Wilson’s exposure, Toensing states, by allowing her husband, former ambassador Joseph Wilson, to go to Niger to look into claims that Iraq was trying to buy uranium from that country (see February 21, 2002-March 4, 2002). Toensing writes that Plame Wilson “suggested” her husband for the trip (see February 13, 2002, February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005). The CIA did not have Wilson write a report, but instead conducted an oral debriefing (see March 4-5, 2002, (March 6, 2002), and March 8, 2002) that, Toensing writes, was never sent to Vice President Dick Cheney’s office (see March 5, 2002). Wilson’s subsequent New York Times op-ed (see July 6, 2003) was not approved or vetted with the CIA’s Prepublication Review Board, something Toensing finds puzzling even though she notes that Wilson was not asked to sign a nondisclosure or confidentiality agreement. She also alleges, without giving specifics, that the statements in Wilson’s op-ed do not jibe with the information in the CIA’s report on his trip, though that report is classified and not available for her inspection. For the CIA to allow Wilson to write the op-ed was, Toensing says, tantamount to giving a green light for Plame Wilson’s exposure as a CIA official. Conservative colunnist Robert Novak, who publicly exposed Plame Wilson (see July 14, 2003), was told by “a still-unnamed administration source” (see June 13, 2003, June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, 8:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, 1:26 p.m. July 12, 2003, and July 12, 2003) that Wilson’s wife “suggested him for the assignment,” leading Novak to uncover Plame Wilson’s identity. Toensing also claims that Novak was never asked not to publish Plame Wilson’s name in anything but the most “perfunctory” fashion (see (July 11, 2003) and Before July 14, 2003). Toensing defends her allegation by writing: “Every experienced Washington journalist knows that when the CIA really does not want something public, there are serious requests from the top, usually the director. Only the press office talked to Mr. Novak.” Toensing goes on to note that the CIA permitted Plame Wilson to make political contributions under the name “Wilson, Valerie E.,” contributions recorded by the Federal Elections Commission. Toensing concludes, “The CIA conduct in this matter is either a brilliant covert action against the White House or inept intelligence tradecraft,” and demands that Congress conduct an investigation into the CIA’s conduct. [Wall Street Journal, 11/3/2005] The Journal does not inform its readers that Toensing was one of a group of lawyers and conservative activists who filed an amici curiae brief with the court asking that it overturn its decision to compel the testimony of two lawyers in the Plame Wilson investigation (see March 23, 2005).
The FBI terminates its two-year investigation into who disseminated the forged documents that alleged Iraq attempted to purchase uranium from Niger (see Between Late 2000 and September 11, 2001, Late September 2001-Early October 2001, October 15, 2001, December 2001, February 5, 2002, February 12, 2002, October 9, 2002, October 15, 2002, January 2003, February 17, 2003, March 7, 2003, March 8, 2003, and 3:09 p.m. July 11, 2003). Italian intelligence chief Nicolo Pollari has confirmed that former Italian intelligence agent Rocco Martino disseminated the documents (see November 3, 2005). FBI chief Robert Mueller has praised Pollari and SISMI’s cooperation with the bureau’s investigation. In part because of information provided by SISMI to the FBI, the bureau concludes that the forgeries were produced by a person or persons for personal profit, and rules out any possibility that SISMI attempted to influence US policies. The Italian newspaper La Repubblica has published a three-part investigative series claiming Pollari had knowingly provided the US and Great Britain with the forgeries (see October 16, 2001, October 18, 2001, December 9, 2001, and September 9, 2002), perhaps at the behest of Italian Prime Minister Silvio Berlusconi, who it says was said to be eager to help President Bush in the search for weapons in Iraq (see (After October 18, 2001)). Berlusconi has denied any involvement. [New York Times, 11/4/2005]
Bob Woodward, a reporter and managing editor for the Washington Post, is interviewed by the office of special counsel Patrick Fitzgerald. Woodward has agreed to testify about being given the identity of covert CIA official Valerie Plame Wilson by former Deputy Secretary of State Richard Armitage (see After October 28, 2005). Armitage, whom Woodward has not yet publicly identified, revealed Plame Wilson’s identity to Woodward in June 2003 (see June 13, 2003). Woodward says Armitage did not realize that Plame Wilson’s CIA status was classified. [Washington Post, 11/16/2005]
Three Democratic congressmen ask Vice President Dick Cheney to testify in the upcoming trial of his former chief of staff, Lewis Libby, even as Libby pled not guilty to five felony counts stemming from the Plame Wilson CIA identity leak investigation (see November 3, 2005). Henry Waxman (D-CA), Maurice Hinchey (D-NY), and John Conyers (D-MI) send a letter to Cheney asking why Cheney’s office gathered information on Valerie Plame Wilson in 2003, whether Cheney directed Libby to leak Plame Wilson’s name to reporters, and whether Cheney knew Libby was leaking that information. “[T]here are many wide-ranging questions about your involvement,” they write. The three congressmen also ask more general questions, such as if Cheney knew the administration’s claims that Iraq sought uranium from Niger were false even as the White House was using those claims to justify its war with Iraq. Cheney spokeswoman Lea Anne McBride says that Cheney will cooperate with the Justice Department as the criminal investigation of special counsel Patrick Fitzgerald moves forward. Cheney and other White House officials could be called to testify if Libby goes to trial. [Associated Press, 11/3/2005]
The US charges British citizen Binyam Ahmed Mohamed (see May-September, 2001), who has allegedly used the aliases Talha al-Kini, Foaud Zouaoui, Taha al-Nigeri, and John Samuel, with conspiracy to foment and carry out terrorist attacks against US targets. Mohamed, who was arrested in Pakistan in April 2002, is charged with “attacking civilians; attacking civilian objects; murder by an unprivileged belligerent; destruction of property by an unprivileged belligerent; and terrorism,” though the charge sheet is unclear whether Mohamed carried out any of these actions himself, or whether he was part of a larger conspiracy by the al-Qaeda terrorist organization. The charges allege links between Mohamed and “shoe bomber” Richard Reid (see December 22, 2001), radical Islamist Abu Zubaida, 9/11 plotter Khalid Shaikh Mohammed, and alleged “dirty bomber” Jose Padilla. Mohamed is alleged to have been part of the Padilla bomb plot. [US Defense Department, 11/4/2005 ] Much of the evidence against Mohamed comes from confessions he allegedly made while in US custody at the detention camp at Bagram Air Force Base (see January-September 2004), and in Guantanamo Bay (see September 2004 and After). He was also held in Pakistan (see April 10-May, 2002 and May 17 - July 21, 2002), and “rendered” to a secret prison in Morocco (see July 21, 2002 -- January 2004). Through his lawyers, Mohamed has claimed that he was tortured in all four detention sites. The British judiciary will later establish that British officials facilitated Mohamed’s interrogation in Pakistan, and had “full knowledge of the reported conditions of his detention and treatment” (see February 24, 2009). [Guardian, 2/5/2009] As with Padilla, the charges relating to the “dirty bomb” plot will later be dropped due to lack of evidence, and all charges against Mohamed will eventually be dropped (see October-December 2008 and February 4, 2009).
Conservative Washington lawyers David Rivkin and Lee Casey publish a guest editorial in the Wall Street Journal defending the Bush administration, and specifically the indicted Lewis Libby (see October 28, 2005), for their actions in the Plame Wilson identity leak. No crime was committed, Rivkin and Casey allege, and no legal ethics were breached. Valerie Plame Wilson’s identity as a CIA official was moot because, Rivkin and Casey write, “she was not a covert agent—a readily ascertainable fact that should have concluded special counsel Fitzgerald’s investigation almost as soon as it got underway” (see Fall 1992 - 1996). In fact, Rivkin and Casey write, exposing Plame Wilson’s role in her husband Joseph Wilson’s 2002 mission to Africa (see February 19, 2002, February 21, 2002-March 4, 2002, July 22, 2003, October 17, 2003, and July 20, 2005) “was relevant to an accurate understanding of his later allegations against the administration.” In general, the lawyers state, it is not a crime to expose an intelligence official’s “classified” status, only genuine covert agents. Since Plame Wilson was not a covert agent, by Rivkin and Casey’s standards, no crime was committed in exposing her as a CIA official. And even had she been, they continue, certainly no damage could have been done by her exposure (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, October 29, 2005, and February 13, 2006). When Wilson decided to publish his New York Times op-ed (see July 6, 2003), the lawyers write, he “eliminated whatever shreds of anonymity” Plame Wilson retained. The lawyers conclude that “the revelation of Ms. Plame [Wilson]‘s connection to the CIA was a public service, neither criminal nor unethical.” [Wall Street Journal, 11/4/2005]
Special prosecutor Patrick Fitzgerald is narrowing his focus on the potential criminal actions of White House political strategist Karl Rove. According to lawyers involved in the Lewis Libby perjury investigation, Fitzgerald is abandoning inquiries into whether Rove lied to a grand jury about his role in the Plame Wilson identity leak, and his characterization of the involvement of President Bush in the leak. Now Fitzgerald is focusing on whether Rove tried to conceal from the grand jury a conversation he had with Time reporter Matthew Cooper in the week before Valerie Plame Wilson’s identity was revealed (see 11:00 a.m. July 11, 2003 and October 15, 2004). Fitzgerald is not sure Rove was fully forthcoming about the belated discovery of an internal e-mail in which he described the conversation with Cooper (see After 11:07 a.m. July 11, 2003 and March 1, 2004), and some within the investigation speculate that Rove may have perjured himself. White House officials have said that Rove will not be asked to leave the administration if he is not indicted. Democratic leaders in Congress have renewed their call for him to resign, reminding Bush of his pledge to demand the “highest ethical standards” from the members of his administration. [New York Times, 11/4/2005] Rove’s lawyer, Robert Luskin, will point to a casual conversation between himself and journalist Viveca Novak as proof that Rove did not deliberately lie about the conversation with Cooper (see March 1, 2004). However, a source familiar with the case tells reporters that Rove had informed Luskin about the Cooper conversation even before his first testimony to the grand jury in February 2004 (see February 2004). Rove then told the jury that he did not remember speaking with Cooper about Plame Wilson. According to the source, Fitzgerald finds it suspicious that Rove did not find the e-mail until after he had subpoenaed Cooper to testify before his grand jury (see May 21, 2004). New York Post editorial writer Deborah Orin echoes charges made by previous columnists in the Wall Street Journal that special counsel Patrick Fitzgerald is conducting a partisan political prosecution of former White House official Lewis Libby (see October 29, 2005 and October 31, 2005), and repeats charges by former Reagan Justice Department official Victoria Toensing that the CIA is behind the exposure of Valerie Plame Wilson’s covert identity (see November 3, 2005). Orin repeats previously made assertions that the CIA allowed Plame Wilson’s exposure by allowing her to send her husband, former ambassador Joseph Wilson, to Niger (see February 13, 2002, February 19, 2002, July 22, 2003, October 17, 2003, and July 20, 2005), failed to have Wilson sign “the usual confidentiality agreement,” and failed to require him to write a written report (see March 4-5, 2002, (March 6, 2002), and March 8, 2002). Orin accuses Wilson of only voicing his public criticism of the Bush administration’s Iraq invasion after he “joined” the presidential campaign of John Kerry (D-MA) in May 2003, even though he began publicly criticizing the administration a year earlier (see May 2002, October 13, 2002, November 2002, December 9, 2002, January 28-29, 2003, February 13, 2003, February 28, 2003, March 3, 2003, March 5, 2003, and March 8, 2003), and the White House began its retaliatory attack against his criticisms in March 2003 (see March 9, 2003 and After). Orin also repeats Toensing’s sourceless assertion that Wilson’s New York Times op-ed about his findings in Niger (see July 6, 2003) “sharply conflicted with what he’d told the CIA.” It was the CIA’s actions, not the White House’s, that led to Plame Wilson’s exposure, Orin avers (see June 13, 2003, June 23, 2003, July 7, 2003, 8:30 a.m. July 8, 2003, July 8, 2003, 11:00 a.m. July 11, 2003, 8:00 a.m. July 11, 2003, Late Afternoon, July 12, 2003, 1:26 p.m. July 12, 2003, and July 12, 2003). Orin quotes Toensing, who said: “It [the Plame Wilson exposure] was a planned CIA covert action against the White House. It was too clever by half.” The reason, Orin says, was to divert attention from its intelligence failures surrounding the US failure to find WMD in Iraq: “Having Wilson go public was very useful to the CIA, especially the division where his wife worked—because it served to shift blame for failed ‘slam dunk’ intelligence claims away from the agency. To say that Bush ‘twisted’ intelligence was to presume—falsely—that the CIA had gotten it right.” The White House was merely defending itself from the CIA’s propaganda onslaught, Orin writes, adding that since Plame Wilson was not a covert agent (see Fall 1992 - 1996), the agency was “dishonest” in claiming that its intelligence operations had been damaged by her exposure (see Before September 16, 2003, October 3, 2003, October 11, 2003, October 22-24, 2003, October 23-24, 2003, October 29, 2005, and February 13, 2006). Defense lawyers for Lewis Libby (see October 28, 2005) indicate that they will shift their defense strategy. Not only will they claim that their client did not intentionally lie to either the FBI (see October 14, 2003 and November 26, 2003) or the grand jury investigating the Plame Wilson CIA identity leak (see March 5, 2004 and March 24, 2004), they will attempt to impugn the credibility and the accuracy of the journalists who are expected to testify that they learned of Valerie Plame Wilson’s CIA identity from Libby, instead of the other way around, as Libby will likely claim. Three reporters—Judith Miller of the New York Times, Matthew Cooper of Time magazine, and Tim Russert of NBC News—are expected to be the prime focus of the defense’s efforts. It is unclear whether any of the reporters will testify voluntarily, or will resist efforts to have them testify before the jury. [Wall Street Journal, 11/7/2005]
Newsweek’s Evan Thomas writes a profile of Lewis “Scooter” Libby, the former chief of staff for Vice President Dick Cheney who is now suspected of leaking CIA officer Valerie Plame Wilson’s name to the press (see June 23, 2003, 8:30 a.m. July 8, 2003, and Late Afternoon, July 12, 2003). Thomas writes that he doubts either Cheney or Libby were “conspiring to trash” former ambassador Joseph Wilson by outing his wife as a CIA officer. Instead, Thomas writes, “it is much more likely they believed that they were somehow safeguarding the republic. It’s also a good bet that they did not foresee the disastrous consequences of their conversation (see (June 12, 2003)), as well as a series of others between Libby and government officials and several reporters in the summer of 2003. Libby, as well as his boss, operated, at least in their own minds, on a higher plane.” Thomas paints Libby as committed to “duty and honor,” and identifying with “Roman centurions and Plato’s Men of Silver, idealized guardians who cared nothing for celebrity or money but lived only to serve.” Libby idealizes former British Prime Minister Winston Churchill, and has compared Cheney to Churchill, who defied English politicians in the 1930s to agitate against the rising threat posed by Adolf Hitler. So, too, is Cheney taking definitive action against the rising threat of Islamist terrorism, Thomas writes, and Libby is determined to assist him. Outing Plame Wilson was “foolish” and centered in “hubris,” Thomas notes, but puts it down to Libby’s “heroic, romantic sense of his boss and his own role in history,” and his going over the line in service to his country. “[I]t is… likely that Libby was caught up in an ancient trap of the best and the brightest,” Thomas writes, “the belief that they do not have to play by normal rules when they serve a higher calling, and that small lies can be told to protect higher truths.” [Newsweek, 11/7/2005]
The Village Voice’s Sydney Schanberg castigates Washington Post reporter and managing editor Bob Woodward for his behavior in the Plame Wilson investigation. Schanberg is referring to Woodward’s repeated attacks on the investigation and his support for the Bush administration (see December 1, 2004, July 7, 2005, July 11, 2005, July 17, 2005, July 31, 2005, and October 27, 2005). He is as yet unaware of Woodward’s status as a recipient of the Valerie Plame Wilson identity leak (see June 13, 2003 and November 14, 2005). Woodward is a rightful icon of investigative journalism due to “the groundbreaking shoe-leather reporting he and Carl Bernstein did on the Watergate scandal in 1972” (see June 15, 1974). Now, though, Schanberg writes, he has become just another well-connected Washington insider. “Doesn’t Woodward remember the reaction by many in the White House press corps, who initially sneered at the [Watergate] story and brushed it off as the fevered product of two lowly cityside reporters covering crime and the courts—which is what Woodward and Bernstein were at the time? I wish I were wrong, but to me Woodward sounds as if he has come a long way from those shoe-leather days—and maybe on a path that does not become him. He sounds, I think, like those detractors in 1972, as they pooh-poohed the scandal that unraveled the Nixon presidency—the scandal that Woodward and Bernstein doggedly uncovered.” Schanberg believes that Woodward has sacrificed his independence and his aggressive stance as an investigator in order to receive the unprecedented access to the White House and other Washington governmental agencies that he enjoys as a high-profile political author. “Critics in the press have suggested that Woodward is too close to some of his sources to provide readers with an undiluted picture of their activities,” Schanberg notes. “His remarks about the Fitzgerald investigation convey the attitude of a sometime insider reluctant to offend—and that is hardly a definition of what a serious, independent reporter is supposed to be. It’s a far piece from Watergate.” [Village Voice, 11/8/2005]
Brett Tolman. [Source: ABC4 (.com)]Brett Tolman, a Republican Senate Judiciary Committee official, tells Assistant Attorney General William Moschella that he will perform a “comprehensive fix” to the USA Patriot Act reauthorization coming up for approval in Congress (see March 9, 2006). Tolman and Moschella are referring to a provision in the reauthorization legislation that would allow the attorney general to appoint interim US Attorneys on an indefinite basis without having them go through Senate confirmation, and remove the ability of a federal court to appoint a US Attorney (see July 2005 - March 2006). Moschella suggests Tolman use the “comprehensive fix” of repealing Section 546 of Title 28 of the United States Code, subsections C and D, and replacing them with the following language: “A person appointed as United States Attorney under this section may serve until the qualification of a United States Attorney for such district appointed by the president under section 541 of this title.” Late the same evening, Tolman receives an email from Moschella instructing him to quietly insert the provision in the USA Patriot Act reauthorization bill that would eliminate a 120-day limit for “interim” US Attorneys to serve without Senate confirmation. In essence, the provision would allow such “interims” to serve indefinitely, cutting the Senate entirely out of the process of naming US Attorneys and allowing the attorney general to make political appointments without oversight. Tolman replies, “I will get the comprehensive fix done.” He slips the provision into a draft of the bill while it is in conference committee. None of the members notice the provision, and it is part of the bill as signed into law in March 2006 (see March 9, 2006). Tolman himself is one of the first beneficiaries of the new provision, becoming the US Attorney for Utah. When the new provision comes to light in early 2007, both chambers of Congress vote overwhelmingly to repeal it. This is one of numerous “stealth provisions” the White House will have inserted into legislation with the help of compliant Congressional Republicans and staffers. [Savage, 2007, pp. 316; US Department of Justice, 3/23/2007 ] Moschella will later take the credit for the provision, and will tell reporters that he made the change on behalf of the Justice Department “without the knowledge or coordination of his superiors at the Justice Department or anyone at the White House.” [Talking Points Memo, 2011]
Time reporter Viveca Novak testifies in the Plame Wilson leak investigation. She and her lawyer, Hank Schuelke, meet in Schuelke’s office with special prosecutor Patrick Fitzgerald. Fitzgerald agrees to limit his questioning to Novak’s conversations with Robert Luskin, the lawyer for White House political adviser Karl Rove (see March 1, 2004). In Novak’s later writing, she characterizes the questioning as “No fishing expeditions, no questions about my other reporting or sources in the case.” Fitzgerald says he wants to “remove the chicken bone without disturbing the body.” He asks general questions about when and how often Novak met with Luskin during the period from the fall of 2003 through the fall of 2004; Novak says they met about five times, but she took no notes from their meetings as Luskin did not speak as freely when she took notes. Then Fitzgerald gets to the “chicken bone,” asking if Luskin ever discussed Rove telling reporter Matthew Cooper that Valerie Plame Wilson was a CIA agent (see 11:00 a.m. July 11, 2003). Novak reveals the contents of her conversation with Luskin, and tells Fitzgerald that she believes the conversation may have occurred in May 2004, though she is not sure. As the meeting comes to an end, Fitzgerald tells her that he may want her to testify again, this time under oath. He does not foresee needing to bring her before his grand jury. Eight days later, Schuelke will inform Novak that Fitzgerald does indeed want her to testify under oath (see December 8, 2005). [Time, 12/11/2005]
The National Review publishes an editorial by Cesar Conda, an assistant to Vice President Dick Cheney from January 2001 to September 2003. Conda writes a glowing defense of indicted perjurer Lewis Libby, whom he worked with in Cheney’s office. Conda notes that he was not “personally close” to Libby, and says he has not spoken to him since December 2004. Conda claims no access to the Libby defense team, nor any knowledge of the Libby defense strategy. However, he writes, “I have my own observations of the man, and some commonsense arguments that should to be considered as they relate to the indictment.” Conda calls the portrayal of Libby in special counsel Patrick Fitzgerald’s indictment of him (see October 28, 2005) a “caricature” that “is utterly at odds with his professional and personal history.” Libby, Conda writes, “is honorable, discreet, selfless—a man of unquestionable integrity. Most of his professional career has been spent in public service, as a behind-the-scenes, yet invaluable staffer at the Department of State, the Department of Defense, and the Congress.” Libby served in Cheney’s office “at great personal sacrifice,” according to Conda, choosing to leave “a lucrative private law practice” and “compromis[ing] family time with his two grade-school children—to focus his energies on his all consuming job in the White House.” Conda goes into detail about Libby’s overwhelming workload, a key element of the Libby defense team’s “memory defense” (see January 31, 2006). According to Conda, Libby should be expected to misremember some “fleeting” conversations he may have had with reporters about former ambassador Joseph Wilson and Wilson’s wife, CIA official Valerie Plame Wilson (see June 23, 2003, 8:30 a.m. July 8, 2003, 2:24 p.m. July 12, 2003, Late Afternoon, July 12, 2003, July 10 or 11, 2003, October 14, 2003, November 26, 2003, March 5, 2004, and March 24, 2004). Conda claims that Wilson is at the heart of the Libby indictment, and accuses him of falsifying his report about the Iraq-Niger uranium hoax (see March 4-5, 2002 and July 6, 2003). Conda concludes by praising Libby as a man whose “noble” goal was “to protect the American people from terrorism.” [National Review, 11/10/2005]
Attorney General Alberto Gonzales sends a letter to a federal judge in Montana, assuring him that US Attorney William W. Mercer is not violating federal law by spending almost all of his time in Washington as a temporary Justice Department official. The same day, Mercer has a Republican Senate staffer insert language into the USA Patriot reauthorization bill (see March 9, 2006) that would retroactively change the rules and allow federal prosecutors such as himself to live outside their districts and serve in other positions. Congress will include the language in the bill when it passes the legislation. Mercer and a small number of other Justice Department employees are the only ones to benefit from the provision. In 2007, when the provision is revealed to the public, Justice Department officials will say the provision was necessary to ensure that prosecutors such as Mercer could fill temporary positions in Washington, Iraq, and elsewhere. Critics will accuse Gonzales of being, in the Washington Post’s words, “less than truthful” about the actions of himself, his staff, and the White House. The question surrounding Mercer involves residency. Mercer is the US Attorney for Montana, appointed in 2001. In June 2005, he was appointed to serve as principal associate deputy attorney general, at Gonzales’s request. US District Chief Judge Donald W. Molloy of Billings has become increasingly irked at Mercer’s absence from Montana for the last two years. In October, Molloy wrote Gonzales to say that Mercer was violating federal law because he “no longer resides in Montana” and was living with his family in the Washington area. Gonzales replies three weeks later to tell Molloy that Mercer “is in compliance with the residency requirement” under federal law because he “is domiciled there, returns there on a regular basis, and will live there full-time as soon as his temporary assignment is completed.” At the same time Gonzales writes Molloy, Mercer has a Senate staffer, Brett Tolman, insert the provision into the Patriot Act legislation. Tolman is the counsel for Senator Arlen Specter (R-PA), chairman of the Senate Judiciary Committee. Tolman will later be named the US Attorney for Utah. Specter’s office will characterize the provision as “unremarkable” and aboveboard. Mercer currently serves as acting associate attorney general and has been nominated for the position on a permanent basis. He spends only about three days a month in Montana and delegates almost all of his duties as US Attorney to underlings. [ePluribus Media, 3/26/2007; Washington Post, 5/2/2007] Mercer will be nominated to serve as associate attorney general, the third-highest position in the Justice Department, in September 2006. He will not be confirmed for the position by the Senate, as confirmation would require his leaving the position of US Attorney. In June 2007, Mercer will resign from the associate attorney general position, retaining his position as US Attorney for Montana (see June 22, 2007). Washington Post reporter Bob Woodward testifies under oath in a sworn deposition to special counsel Patrick Fitzgerald concerning his knowledge of the identity of outed CIA agent Valerie Plame Wilson (see December 30, 2003), and how he came upon that knowledge. Woodward testifies that he spoke “with three current or former Bush administration officials” in regards to his book Plan of Attack. He testifies for two hours under an agreement that he will only discuss matters specifically relevant to Fitzgerald’s investigation, and with written statements from each of the three administration officials waiving confidentiality “on the issues being investigated by Fitzgerald.” Woodward’s name came to Fitzgerald’s attention after one of the three officials, former Deputy Secretary of State Richard Armitage, told Fitzgerald that he had revealed Plame Wilson’s identity to Woodward (see June 13, 2003 and After October 28, 2005). In his story for the Post about his testimony, Woodward does not reveal Armitage’s identity, but it is soon disclosed by other sources (see March 14, 2006). Woodward spoke with a second administration official, whose identity he also does not disclose, and with Vice President Dick Cheney’s chief of staff, Lewis “Scooter” Libby, but says he did not discuss Plame Wilson with either Libby or the other official (see June 23, 2003). He testifies that he did not discuss Plame Wilson with any other government officials (see June 20, 2003) before Robert Novak publicly outed her on July 14 (see July 14, 2003). Woodward notes, “It was the first time in 35 years as a reporter that I have been asked to provide information to a grand jury.” [Washington Post, 11/16/2005; Washington Post, 11/16/2005; Washington Post, 7/3/2007] Investigative reporters for the progressive news Web site Raw Story identify National Security Adviser Stephen Hadley as Woodward’s source for Plame Wilson’s identity, a claim echoed by the Times of London. Hadley refuses to answer questions on the topic. [Raw Story, 11/16/2005; London Times, 11/20/2005] In 2006, the National Security Council will refuse to directly deny Hadley’s involvement, and will request that Raw Story attribute denials to the White House and not to itself.) Woodward Told Second Reporter about Plame Wilson - Woodward testifies that he told another reporter about Plame Wilson: “I told Walter Pincus, a reporter at the Post, without naming my source, that I understood Wilson’s wife worked at the CIA as a WMD analyst.” Pincus says he has no memory of Woodward telling him anything about Plame Wilson, and says he would certainly have remembered such a conversation, especially since he was writing about Plame Wilson’s husband, war critic Joseph Wilson, at the time (see June 3, 2003, June 11, 2003, June 12, 2003, and (July 11, 2003)). “Are you kidding?” Pincus says. “I certainly would have remembered that.” Pincus believes Woodward is confused about the timing and the nature of their conversations; he remembers Woodward making a vague allusion to Plame Wilson in October 2003. That month, Pincus had written a story explaining how an administration source had contacted him about Wilson. Pincus recalls Woodward telling him that he was not the only person who had been contacted.
Libby Lawyer: Woodward's Testimony Undermines Case against Client - Lewis Libby’s lawyer, William Jeffress, says Woodward’s testimony undermines the case Fitzgerald is building against his client (see October 28, 2005). “If what Woodward says is so, will Mr. Fitzgerald now say he was wrong to say on TV that Scooter Libby was the first official to give this information to a reporter?” Jeffress says. “The second question I would have is: Why did Mr. Fitzgerald indict Mr. Libby before fully investigating what other reporters knew about Wilson’s wife?” [Washington Post, 11/16/2005]

Critics of the Bush administration, and of the reporters who helped push its narrative regarding the Iraq invasion, lambast Washington Post reporter Bob Woodward for failing to reveal himself as a recipient of the Valerie Plame Wilson identity leak (see June 13, 2003, November 14, 2005, and November 16-17, 2005) while himself attacking the Plame Wilson investigation (see December 1, 2004, July 7, 2005, July 11, 2005, July 17, 2005, July 31, 2005, and October 27, 2005). Joshua Micah Marshall writes that while the story of Woodward’s involvement remains “sketchy,” it appears “that Woodward—who has long been publicly critical of the Fitzgerald investigation—has been part of it from the beginning. Literally, the beginning.… At a minimum, though, Woodward seems to have some explaining to do, at least for the fact that he became an aggressive commentator on the leak story without ever disclosing his own role in it, not even to his editors.” [Talking Points Memo, 11/15/2005] The Washington Monthly’s Kevin Drum calls Woodward’s behavior “bizarre,” and says, “I can’t begin to make sense of this.” [Washington Monthly, 11/17/2005] The Washington Post’s Howard Kurtz asks, “Who was this Shallow Throat, and why is this the first we’re hearing about it?” [Washington Post, 11/16/2005] Liberal author and blogger Jane Hamsher is particularly caustic in her criticism, writing: “Woodward stopped being a ‘journalist’ in the true sense of the word long ago—when he decided celebrity status and book sales meant more than the truth. He has gone from being—well, whatever he was, to something much worse: an official peddler of lies told by powerful people to whitewash their criminal activities.” [Jane Hamsher, 11/15/2005] And John Aravosis of the liberal AmericaBlog writes: “It’s also beginning to sound a lot like Bob Woodward is becoming our next Judith Miller (see October 16, 2005). His repeated rants in defense of this administration, and against the special prosecutor, certainly take on a very interesting edge considering Mr. Woodward didn’t bother disclosing that he was quite involved in this story, and was hardly the impartial observer his silence suggested he was. Not to mention, he knew all along that HE TOO had received the leak, suggesting that a clear pattern of multiple leaks was developing, yet he still went on TV and said that all of these repeated leaks were just a slip of the tongue?” (Emphasis in the original.) A White House document shows that oil company executives lied in recent Senate hearings when they denied meeting with Vice President Cheney’s energy task force (the National Energy Policy Development Group—see May 16, 2001) in 2001. The document, obtained by the Washington Post, shows that officials from ExxonMobil, Conoco (before it merged with Phillips), Shell Oil, and British Petroleum met with the task force (see March 22, 2001). Last week, the CEOs of ExxonMobil, Chevron, and ConocoPhillips denied participating in the task force’s deliberations. Shell Oil’s CEO said his company did not participate “to my knowledge,” and the chief of BP America said he did not know. Though Chevron is not named in the White House document, that firm and others “gave detailed energy policy recommendations” to the task force, according to the Government Accountability Office. Cheney also met separately with John Browne, BP’s chief executive, in a meeting not included in the document. Environmentalists have long stated that they were almost entirely shut out of the deliberations, while corporate interests were heavily represented (see April 4, 2001). The Supreme Court ruled in 2004 that the government could keep the records of the task force secret (see June 24, 2004). Senator Frank Lautenberg (D-NJ) says, “The White House went to great lengths to keep these meetings secret, and now oil executives may be lying to Congress about their role in the Cheney task force.” Since the oil executives were not under oath—a decision by Senate Commerce Committee chairman Ted Stevens (R-AK) protested by committee Democrats—they cannot be charged with perjury. However, they can be fined or imprisoned for up to five years for making “any materially false, fictitious or fraudulent statement or representation” to Congress. After the Washington Post releases the document, former Conoco manager Alan Huffman confirms, “We met [with the task force] in the Executive Office Building, if I remember correctly.” A ConocoPhillips spokesman says that CEO James Mulva had been unaware of the meetings when he testified at the hearing. ExxonMobil says it stands by CEO Lee Raymond’s denials; James Rouse, an Exxon official named in the document (see Mid-February, 2001), denies meeting with the task force, calling the document “inaccurate.” [Washington Post, 11/16/2005]

Representative Henry Waxman (D-CA), the ranking member of the House Oversight Committee, writes a letter to committee chairman Tom Davis (D-VA), asking that the committee open an investigation into the Valerie Plame Wilson identity leak. Waxman’s letter will not receive a response. Davis has already ignored five similar letters from Waxman (see September 29, 2003, October 8, 2003, December 11, 2003, July 11, 2005, and October 28, 2005). [Waxman, 12/2005]
Washington Post reporter Bob Woodward acknowledges testifying in the Plame Wilson investigation (see November 14, 2005), and apologizes to the Post for failing to tell editors and publishers that a senior Bush administration official told him over two years ago that Valerie Plame Wilson was a CIA officer (see June 13, 2003). Woodward is a reporter and assistant managing editor at the Post. While speculation has been rife over which reporters knew of Plame Wilson’s identity, and which administration officials are responsible for blowing her covert status, Woodward has never admitted to being a recipient of the leaked information, and has repeatedly attacked the investigation (see December 1, 2004, July 7, 2005, July 11, 2005, July 17, 2005, July 31, 2005, and October 27, 2005). Woodward explains that he did not reveal his own involvement in the case—that Deputy Secretary of State Richard Armitage informed him of Plame Wilson’s CIA status—because he feared being subpoenaed by special prosecutor Patrick Fitzgerald. Woodward says he was trying to protect his sources. “That’s job number one in a case like this,” he says. “I hunkered down. I’m in the habit of keeping secrets. I didn’t want anything out there that was going to get me subpoenaed.” Woodward told his editors about his knowledge of the case shortly after former White House aide Lewis “Scooter” Libby was indicted for perjury and obstruction of justice (see October 28, 2005). Woodward 'Should Have Come Forward' - Executive editor Leonard Downie Jr. says Woodward “made a mistake.… [H]e still should have come forward, which he now admits. We should have had that conversation.… I’m concerned that people will get a mis-impression about Bob’s value to the newspaper and our readers because of this one instance in which he should have told us sooner.” Downie adds: “After Libby was indicted, [Woodward] noticed how his conversation with the source preceded the timing in the indictment. He’s been working on reporting around that subject ever since the indictment.”
Questions of Objectivity, Honesty - Woodward’s silence about his own involvement while repeatedly denigrating the investigation causes many to question his objectivity. “It just looks really bad,” says Eric Boehlert, an author and media critic. “It looks like what people have been saying about Bob Woodward for the past five years, that he’s become a stenographer for the Bush White House” (see November 25, 2002). Journalism professor Jay Rosen says flatly, “Bob Woodward has gone wholly into access journalism.” And Robert Zelnick, chair of Boston University’s journalism department, says: “It was incumbent upon a journalist, even one of Woodward’s stature, to inform his editors.… Bob is justifiably an icon of our profession—he has earned that many times over—but in this case his judgment was erroneous.” Rem Rieder, the editor of American Journalism Review, says Woodward’s disclosure is “stunning… [it] seems awfully reminiscent of what we criticized Judith Miller for.” Miller, a reporter for the New York Times, was accused by Times executive editor Bill Keller of misleading the paper by not informing her editors that she had discussed Plame Wilson’s identity with Libby (see October 16, 2005). Rieder calls Woodward “disingenuous” for his criticism of the investigation (see July 7, 2005, July 11, 2005, July 17, 2005, and October 27, 2005) without revealing his own knowledge of the affair. Columnist and reporter Josh Marshall notes, “By becoming a partisan in the context of the leak case without revealing that he was at the center of it, really a party to it, he wasn’t being honest with his audience.” Woodward claims he only realized his conversation with Armitage might be of some significance after Libby was described in the indictment as the first Bush official to reveal Plame Wilson’s name to reporters. Armitage told Woodward of Plame Wilson’s identity weeks before Libby told Miller. Unlike Libby, Armitage did not release Woodward from his promise to protect his identity (see September 15, 2005). Woodward Denies Quid Pro Quo - Some time later, a colleague will ask Woodward if he were trading information with Armitage on a friendly, perhaps less-than-professional basis. “Was this a case of being in a relationship where you traded information with a friend?” Woodward will respond sharply: “It’s not trading information. It is a subterranean narrative. What do you have? What do you know? If you start making this a criminal act, people will not speak to you.” [Vanity Fair, 4/2006]

Representative John Murtha (D-PA) introduces a bill in the House to compel the redeployment of US troops out of Iraq “at the earliest practicable date.” Murtha introduces the bill in conjunction with his public call for withdrawal (see November 17, 2005). The bill states that “clear, measurable progress towards” a stable economy or a secure populace has not been shown. Additionally, the bill states that it would take so many additional US troops to force stability that the US government would be forced to reinstate the military draft; that “US forces have become the target of the insurgency;… over 80 percent of the Iraqi people want the US forces out of Iraq;… 45 percent of the Iraqi people feel that the attacks on US forces are justified; and [therefore] Congress finds it evident that continuing US military action in Iraq is not in the best interests of the United States of America, the people of Iraq, or the Persian Gulf Region.” The bill never makes it out of committee. [US House of Representatives, 11/17/2005]
A Washington Post analysis posits that the revelation that Post reporter Bob Woodward was the first to learn of Valerie Plame Wilson’s CIA identity (see June 13, 2003 and November 14, 2005) may “provide a boost” to the legal defense of indicted White House leaker Lewis Libby (see October 28, 2005). Woodward has testified that another government official leaked Plame Wilson’s name to a member of the press—himself—well before Libby’s leaks to other reporters (see June 23, 2003, 8:30 a.m. July 8, 2003, 2:24 p.m. July 12, 2003, and Late Afternoon, July 12, 2003). Furthermore, Woodward has testified that Libby did not divulge Plame Wilson’s name to him during their two conversations in late June (see June 23, 2003 and June 27, 2003), a time period in which special counsel Patrick Fitzgerald says Libby was passing information about Plame Wilson to reporters and colleagues. The Post writes, “While neither statement appears to factually change Fitzgerald’s contention that Libby lied and impeded the leak investigation, the Libby legal team plans to use Woodward’s testimony to try to show that Libby was not obsessed with unmasking Plame and to raise questions about the prosecutor’s full understanding of events.” Former federal prosecutor John Moustakas says: “I think it’s a considerable boost to the defendant’s case. It casts doubt about whether Fitzgerald knew everything as he charged someone with very serious offenses.” But Randall Eliason, formerly the head of the public corruption unit in the Washington, DC, US Attorney’s Office, says he doubts the Woodward account will have much effect on Libby’s case, and calls such theories “defense spin.” Eliason says: “Libby was not charged with being the first to talk to a reporter, and that is not part of the indictment. Whether or not some other officials were talking to Woodward doesn’t really tell us anything about the central issue in Libby’s case: What was his state of mind and intent when he was talking to the FBI and testifying in the grand jury?… What this does suggest, though, is that the investigation is still very active. Hard to see how that is good news for [White House deputy chief of staff Karl] Rove or for anyone else in the prosecutor’s cross hairs.” The Libby defense team is calling Woodward’s testimony a “bombshell” with the potential to derail Fitzgerald’s case. Rove’s defense lawyers add that Woodward’s testimony benefits their client also. A source the Post calls “close to Rove” says: “It definitely raises the plausibility of Karl Rove’s simple and honest lapses of memory, because it shows that there were other people discussing the matter in what Mr. Woodward described as very offhanded, casual way. Let’s face it, we don’t all remember every conversation we have about significant issues, much less those about those that are less significant.” [Washington Post, 11/17/2005] Criminal defense lawyer Jeralyn Merritt, writing for the progressive blog TalkLeft, notes: “Fitzgerald did not say that Libby was the first administration official to disclose Valerie Plame Wilson’s identity to a reporter. He said Libby was the first person known to the government to have disclosed her identity. There’s a sea of difference between the two.… I think it’s perfectly clear what Fitzgerald meant in light of his statement at the beginning of the conference—Libby was the first person the investigation uncovered who disclosed the information to a reporter. I see nothing in Woodward’s revelations that affect the charges against Libby. He’s not charged with leaking Plame Wilson’s identity or with engaging in a vendetta against Wilson, although some have said he did both. He’s charged with lying to Fitzgerald’s investigators and the grand jury about what he told reporters and when and what reporters told him—and obstructing justice.” [Jeralyn Merritt, 11/16/2005]
Lawyers David Rivkin and Lee Casey demand that special counsel Patrick Fitzgerald drop his prosecution of former White House official Lewis Libby. In a Washington Times editorial, Rivkin and Casey write that, because Washington Post reporter Bob Woodward has admitted to being the recipient of leaked information about CIA official Valerie Plame Wilson before Libby leaked her covert identity (see November 14, 2005), it is possible that Woodward himself told Libby of Plame Wilson’s CIA status—it is possible that Libby merely “misremembered” the reporter who told him as NBC’s Tim Russert, when it was likely Woodward (see July 10 or 11, 2003). Moreover, the lawyers assert, the likelihood of a jury actually convicting Libby of perjury and obstruction of justice (see October 28, 2005) is unlikely in light of Woodward’s revelation and the “reasonable doubt” they say Woodward’s recent testimony raises. Rivkin and Casey echo previous assertions that the CIA did not bother to ensure the safety of Plame Wilson’s covert status (see November 3, 2005), in effect blaming the agency for her identity being exposed. [Washington Times, 11/17/2005] Rivkin and Casey, in a previous Washington Times editorial, called the exposure of Plame Wilson a “public service” (see November 4, 2005).
