Philadelphia is rocked by a series of conflicts that will become known as the “Bible Riots of 1844.” In the 1830s, Philadelphia, a large factory town, began simmering with conflicts and issues between a large and disparate number of groups, roughly divided into two: Irish and German immigrants, mostly Catholics, who are fighting for better working conditions and better treatments both through the Church and through the burgeoning labor movement; and “nativists,” a loose movement that has arisen in something of a backlash against the large influx of immigrants. Many of the Irish and German immigrants have become identified with urban Democratic political machines, sparking resentment among non-Democratic “native” Americans. The Irish in particular become targets of the “nativist” movement. In 1844, Catholics begin mounting complaints that their children are being forced to read from the Protestant King James Bible in public school every day. That version of the Bible (often abbreviated KJV) is required reading in Philadelphia public schools, in part because of the efforts of Pennsylvania legislator James Buchanan, who pushed through some of the country’s first legislation requiring public schools; however, the Pennsylvania legislature inserted language into the bill requiring daily Bible reading. Catholics see the mandated daily Bible readings as an attempt to undermine their religion, a view given credence when their requests that the KJV be substituted with Catholic Bibles are ignored. The complaints spark a series of riots that target Irish Catholic churches (no German Catholic churches are burned or vandalized, in part because Irish Catholics, a larger and more prominent group than the Germans, tend to be more vocal and are more closely identified with the “problem”). In response, groups of Irish Catholics target Protestant churches. The Philadelphia city government does little if anything to protect either group. Both sides accuse the other of vandalism and duplicity; the “nativists” insist that the Catholics want to install the Pope as the leader of the US government, and the Catholics accuse city officials of letting the “nativists” attack them at will. The riots result in a number of churches being partially or completely burned, at least 20 people dead, and the Irish Catholics becoming more forceful and more organized, taking a more aggressive part in politics and the labor movement. The US Supreme Court rules in Dred Scott v. Sandford that African-Americans are not citizens regardless of their status as free or slave, and therefore cannot sue for redress in federal courts. The Court also rules that Congress has no power to ban slavery in US territories, and that the rights of slaveowners are protected by the Fifth Amendment because slaves are categorized as property. The origins of the case date to 1833 when Army surgeon Dr. John Emerson purchased Dred Scott, a slave, and moved him to a military base in Wisconsin. Slavery was banned in territories made free by the Missouri Compromise, and Wisconsin was one of these territories. However, Scott did not assert his freedom at that time. Instead, he lived in Wisconsin for four years, sometimes hiring himself out for work. In 1840, Scott moved with his family to Louisiana and then to St. Louis, Missouri, with Emerson. After Emerson died, Scott attempted to buy his family’s freedom from Emerson’s wife Eliza Irene Sanford, but was refused. (Sanford’s name was misspelled ‘Sandford’ in court documents.) Scott then sued Sanford in a state court, arguing that he and his family were free because they lived in a territory where slavery was illegal, and that he was owed back wages. A state court found in Scott’s favor in 1850, but Sanford’s brother John appealed the decision. The Missouri Supreme Court overturned the original decision. Scott, alleging physical abuse, then sued John Sanford for damages in a federal court, but a jury disallowed Scott’s right to file a case in federal court. Scott appealed this decision to the Supreme Court. In a majority opinion written by Chief Justice Roger B. Taney, the Court finds that it lacks jurisdiction to take the case because Scott is not a US citizen. Taney writes that Scott is “a negro, whose ancestors were imported into this country and sold as slaves,” and, therefore, he is not a “member of the political community formed and brought into existence by the Constitution.” Taney also dismisses Scott’s assertion that his residence in a free state automatically grants him freedom and status as a US citizen, reasoning that states may choose to recognize the rights of freed slaves as citizens, but the federal government is under no obligation to do so. Lastly, the Court finds that, because slaves are property, Congress’s ban on slavery in the territories violates the Fifth Amendment’s protection of property rights. Justice Benjamin Curtis issues a powerful dissent to the Taney opinion. The Court’s decision will exacerbate tensions between Northern and Southern states, being widely seen as validating the South’s view of national power. It will also embolden pro-slavery Southerners and others to try to extend slavery into other areas of the nation, and will infuriate abolitionists, who will become powerful voices within the newly formed Republican Party. The three “Reconstruction Amendments”—the Thirteenth, Fourteenth, and Fifteenth (see February 26, 1869)—will render the Scott decision invalid. In modern times, all people born or naturalized in the US will be considered citizens who have the right to bring suit in federal court. (McBride 12/2006)
The US Congress passes the Fifteenth Amendment, giving African-American men, and in theory men of other minorities, the right to vote. The Amendment reads, “The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.” Over a century later, the American Civil Liberties Union (ACLU) will write, “In addition to the Thirteenth Amendment, which abolishes slavery, and the Fourteenth Amendment, which guarantees equal protection under the law, the Fifteenth Amendment is one of the major tools which enabled African-Americans to more fully participate in democracy.” It will be ratified by the states in 1870. The US Supreme Court uses the “Slaughterhouse Cases” to narrowly interpret the Fourteenth Amendment (see July 9, 1868). The combined cases have nothing to do with the rights of freed African-Americans, but center on disputes brought to court by white businessmen. The Court rules 5-4 that distinctions exist between federal and state citizenship rights, and that states have no obligation to provide their citizens with the same “privileges and immunities” they enjoy as national citizens. The US Congress denies Chinese-Americans the right to vote or be citizens by passing the Chinese Exclusion Act. Historian William Wei will later write that the Exclusion Act was driven by decades of racism against Chinese immigrants, with the express goal of “driv[ing] them out of the country. This hostility hindered efforts by the Chinese to become American. It forced them to flee to the Chinatowns on the coasts, where they found safety and support. In these ghettos, they managed to eke out a meager existence, but were isolated from the rest of the population, making it difficult if not impossible to assimilate into mainstream society. To add insult to injury, Chinese were criticized for their alleged unassimilability.” The Exclusion Act is the first such legislation in US history to name a specific group of people “as undesirable for immigration to the United States,” and “marked a fateful departure from the traditional American policy of unrestricted immigration.” (Harper's Weekly 1999; American Civil Liberties Union 2012) The Exclusion Act will be repealed over 60 years later (see December 17, 1943).
The US Supreme Court strikes down the provision of an 1875 civil rights law that prohibited racial discrimination by owners of hotels, theaters, and other forms of public accommodation. The Court consolidates a number of cases from four states into the “Civil Rights Cases,” and rules that the Fourteenth Amendment (see July 9, 1868) does not give the federal government the power to ban private discrimination. Further, the court rules that the denial of public accommodation does not constitute a “badge of slavery” and is therefore not prohibited by the Thirteenth Amendment, which ended slavery in the US. Florida’s legislature passes a number of laws designed to disenfranchise African-American voters. The provisions include a poll tax and an “eight box law,” under which voters are required to place ballots in correct boxes which are then shifted throughout the day. Between 1888 and 1892, voter turnout among African-Americans will drop from 62 percent to 11 percent. (American Civil Liberties Union 2012)
The Louisiana legislature adopts a so-called “grandfather clause” designed to disenfranchise African-American voters. As a result, the percentage of registered black voters drops from 44.8 percent in 1896 to 4 percent in 1890. Louisiana’s lead is followed by similar laws being passed in Mississippi, South Carolina, Alabama, and Virginia. Louisiana’s “grandfather clause” requires voters to register between January 1, 1897 and January 1, 1898. It imposes a literacy test. Illiterate or non-property owning voters whose fathers or grandfathers were not eligible to vote in 1867 (as per the Fifteenth Amendment—see February 26, 1869) are not allowed to register. Almost all African-Americans were slaves in 1867, and were not allowed to vote. The American Civil Liberties Union will later write, “[T]he measure effectively disfranchises all black voters who cannot read or write or who do not own more than $300 in property.” (School 2011; American Civil Liberties Union 2012)
The US Supreme Court rules 7-1 in Plessy v. Ferguson that a Louisiana law requiring “equal but separate accomodations for the white and colored races” is constitutional. Homer Plessy, a light-skinned black man who sometimes “passed” as white, took part in a plan by a small number of black professionals seeking to have a court overturn the Louisiana Separate Car Act of 1890. Plessy boarded a whites-only railroad car and was arrested, as per arrangement, by a private detective. The group intended to use Plessy’s light skin tone to demonstrate how arbitrary and unconstitutional the law was. Plessy’s lawyers argued that Louisiana’s segregation law violated both the Thirteenth Amendment, which bars slavery, and the Fourteenth Amendment, which guarantees all Americans equal protection under the law (see July 9, 1868). Louisiana courts consistently found against Plessy, and the case moved all the way to the Supreme Court. Writing for the Court’s majority, Justice Henry Brown rules that the law does not “discriminate” among legal rights by race, but merely recognizes a “distinction” between races “which must always exist so long as white men are distinguished from the other race by color.” He adds: “Legislation is powerless to eradicate racial instincts or to abolish distinctions based on physical differences, and the attempt to do so can only result in accentuating the differences of the present situation. If the civil and political rights of both races be equal, one cannot be inferior to the other civilly or politically. If one race be inferior to the other socially, the Constitution of the United States cannot put them on the same plane.” The ruling establishes the “separate but equal” doctrine that informs many states’ decision to segregate public facilities—schools, railcars, even drinking fountains. Justice John Marshall Harlan, a former slave owner and a pro-slavery politician, writes a fiery dissent that refutes Brown’s assertion that the Louisiana law discriminates equally among whites and blacks. Harlan writes, “Everyone knows that the statute in question had its origin in the purpose, not so much to exclude white persons from railroad cars occupied by blacks, as to exclude colored people from coaches occupied by or assigned to white persons.” He disagrees with the majority opinion’s finding that segregation on railcars does not violate African-Americans’ constitutional rights under the Fourteenth Amendment. But Harlan does not advocate social equality among the races. Instead, he argues that legally imposed segregation denies political equality. Harlan writes: “The white race deems itself to be the dominant race in this country. And so it is, in prestige, in achievements, in education, in wealth, and in power. So, I doubt not, it will continue to be for all time, if it remains true to its great heritage, and holds fast to the principles of constitutional liberty. But in view of the Constitution, in the eye of the law, there is in this country no superior, dominant, ruling class of citizens. There is no caste here. Our Constitution is color-blind, and neither knows nor tolerates classes among citizens. In respect of civil rights, all citizens are equal before the law.” Harlan’s dissent becomes the underpinning of the 1954 Brown v. Board of Education decision (see May 17, 1954). The US Supreme Court upholds a Mississippi law requiring citizens to pass a literacy test before being allowed to vote. The Williams v. Mississippi decision holds that such tests do not violate the Fifteenth Amendment (see February 26, 1869) as long as they are applied equally to all prospective voters. The literacy test stemmed from a state “Constitutional convention” that codified a “compromise” between white slaveowners and those who opposed their iron control of the Mississippi state government. The compromise would declare all illiterate Mississippi citizens as ineligible to vote, but the real purpose of the convention—to disenfranchise blacks—was well known. James Kimble Vardaman, who would later become governor, said of the convention: “There is no use to equivocate or lie about the matter. Mississippi’s constitutional convention was held for no other purpose than to eliminate the n_gger from politics; not the ignorant—but the n_gger.” White Republican Marsh Cook challenged the Democrats for a seat to the convention and was murdered in response. The only African-American delegate to the convention, Isaiah Montgomery, was invited because of his willingness to support disenfranchisement. The convention established the literacy test, establishing as a proper test the reading of any selected section of the Mississippi Constitution, or giving a valid explanation of it once it was read to the voter. Registrars would interpret the success or failure of the voters’ attempts to pass the test. Since all Mississippi registrars are white, the likelihood that even a literate African-American would pass the test was slim at best. However, the Court ignores the intent of the law to disenfranchise blacks, writing: “[T]he operation of the constitution and laws is not limited by their language or effects to one race. They reach weak and vicious white men as well as weak and vicious black men, and whatever is sinister in their intention, if anything, can be prevented by both races by the exertion of that duty which voluntarily pays taxes and refrains from crime.” Other states, mainly Southern, will quickly adopt their own version of literacy tests. Alabama modifies its state Constitution to expand criminal disenfranchisement. The state is one of more than 20 to disenfranchise citizens convicted of various felonies and high crimes (see 1802-1857). However, Alabama’s new policies are directly focused on retaining white citizens’ dominance in state and local government. The all-white 1901 Alabama Constitution Convention hears the convention’s president state that the purpose of the convention’s new policies is “within the limits imposed by the Federal Constitution to establish white supremacy.” Since African-Americans have received the right to vote via the Fourteenth and Fifteenth Amendments, Alabama, like a number of other Southern states, is moving to restrict black citizens’ votes in a variety of ways. According to the newly adopted language of the Alabama Constitution: “The following persons shall be disqualified both from registering, and from voting, namely: All idiots and insane persons; those who shall by reason of conviction of crime be disqualified from voting at the time of the ratification of this Constitution; those who shall be convicted of treason, murder, arson, embezzlement, malfeasance in office, larceny, receiving stolen property, obtaining property or money under false pretenses, perjury, subornation of perjury, robbery, assault with intent to rob, burglary, forgery, bribery, assault and battery on the wife, bigamy, living in adultery, sodomy, incest, rape, miscegenation, crime against nature, or any crime punishable by imprisonment in the penitentiary, or of any infamous crime or crime involving moral turpitude; also, any person who shall be convicted as a vagrant or tramp, or of selling or offering to sell his vote or the vote of another, or of buying or offering to buy the vote of another, or of making or offering to make a false return in any election by the people or in any primary election to procure the nomination or election of any person to any office, or of suborning any witness or registrar to secure the registration of any person as an elector.” (ProCon 10/19/2010)
An alliance of the countries of Serbia, Bulgaria, and Montenegro, later to include Greece, demands that the Ottomans immediately grant autonomy to Christians. Serbia then invades Kosova and crosses northern Albania to the coast, Montenegro invades the same region, and Bulgaria invades Macedonia and part of eastern Albania. According to author Paulin Kola, the war is based on a policy called Nacertanije (meaning “draft”), created in the mid-1800s by Serbian foreign minister Ilija Garasanin. Nacertanije advocates annexing Kosova and northern Albania to Greater Serbia, connecting Serbia to the Adriatic. A Serb soldier describes a speech by his commander once they reached Kosova: “‘Brothers, my children, my sons!’ His voice breaks. ‘This place on which we stand is the graveyard of our glory. We bow to the shadows of fallen ancestors and pray God for the salvation of their souls.’ His voice gives out and tears steam down his cheeks and gray beard and fall to the ground. He actually shakes from some kind on inner pain and excitement.… We are the generation which will realize the centuries-old dream of the whole nation: that we with the sword will regain the freedom that was lost with the sword.” The war results in a heavy toll among Kosovar civilians. About 25,000 Albanians are killed, and only three survive the war in the town of Ferizaj. Subsequently, an international commission established by the Carnegie Endowment will say in 1914 that the civilian toll was an intentional policy. Before the war, Serbia denied that Albanians could be independent and dehumanized them, according to Kola. Former Prime Minister Vladan Djordjevic said Albanians were thin, short, and that their Roma and Phoenician traits made him think of primates who slept hanging in trees. After occupation, there are cases of Muslims being forced to convert to Orthodox Christianity, and in one case 500 Albanians are shot for their refusal. (Kola 2003, pp. 11-12)
The US Supreme Court overrules Oklahoma’s “grandfather clause” law in the case of Guinn v. United States, finding the law unconstitutional. The Oklahoma law is similar to laws passed in Louisiana and other states (see 1896) in order to ensure that African-Americans cannot legally vote regardless of the Fifteenth Amendment (see February 26, 1869). Illiterate males can vote only if they can prove their grandfathers had the right to vote. Since almost all African-Americans were slaves during that time, it is impossible for almost all African-Americans to prove their grandfathers had the right to vote. Illiterate white men, however, can often prove their grandfathers could vote. (PBS 12/2006; American Civil Liberties Union 2012)
The US Supreme Court, ruling in the case of Takao Ozawa v. United States, finds that persons of Japanese ancestry are prohibited from becoming naturalized citizens under a law limiting eligibility to “free white persons and to aliens of African nativity and to persons of African descent.” According to the Court, Takao Ozawa is “a graduate of the Berkeley, California, High School, had been nearly three years a student in the University of California, had educated his children in American schools, his family had attended American churches, and he had maintained the use of the English language in his home. That he was well qualified by character and education for citizenship is conceded.” (American Civil Liberties Union 2012)
The US Supreme Court rules that “high caste Hindus” from India are not eligible to become US citizens because, under naturalization law, persons of Hindu ancestry are not “white.” Bhagat Singh Thind came to the United States in 1913, served in the US Army, and was granted permission to become a citizen by an Oregon official. However, a naturalization examiner objected and took the case to court. In Bhagat Singh Thind v. United States, the Court finds that Thind may not be naturalized because of his Hindu ancestry. Thind presented evidence that South Asians such as himself are scientifically classified as Aryans or Caucasians, and thusly should be classified as “white.” The Court rules that scientific evidence is secondary to the public perception of who is white and who is not. “It may be true that the blond Scandinavian and the brown Hindu have a common ancestor in the dim reaches of antiquity,” the Court finds, “but the average man knows perfectly well that there are unmistakable and profound differences between them today.” In essence, the Court contradicts its findings from a ruling three months ago, where it accepted scientific proof that a Japanese man applying for American citizenship could not be classified as “white.” In 2003, documentarians for California Newsreel will write: “The justices never said what whiteness was, only what it wasn’t. Their implied logic was a circular one: Whiteness was what the common white man said it was.” Many South Asians who had been naturalized will be stripped of their citizenship and property as a result of the ruling. One, successful businessman Vaishno das Bagai, kills himself. He leaves a suicide note for his family and another one for the public that reads in part: “But now they come and say to me I am no longer an American citizen. What have I made of myself and my children? We cannot exercise our rights, we cannot leave this country. Humility and insults… blockades this way, and bridges burned behind.” The Court will later reverse itself and rule in Thind’s favor. (California Newsreel 2003; United States v. Congress passes the Indian Citizenship Act of 1924, which makes all non-citizen Native Americans born within the US citizens, thus granting them the right to vote. It will be signed into law by President Calvin Coolidge. Before the act takes effect, Native Americans had an unusual status under the law. Some had acquired citizenship by marrying white males, others received citizenship through military service, allotments, or through special treaties or statutes (see May 26, 1920). The act was less of a response to Native Americans petitioning for citizenship than an effort by the federal government to “absorb” Native Americans into mainstream America, a policy known by some historians as “assimilation.” Before the act is passed, Dr. Joseph K. Dixon, a proponent of “assimilation,” wrote: “The Indian, though a man without a country, the Indian who has suffered a thousand wrongs considered the white man’s burden and from mountains, plains, and divides, the Indian threw himself into the struggle to help throttle the unthinkable tyranny of the Hun. The Indian helped to free Belgium, helped to free all the small nations, helped to give victory to the Stars and Stripes. The Indian went to France to help avenge the ravages of autocracy. [Dixon is referencing many Native Americans’ service in the US military during World War I.] Now, shall we not redeem ourselves by redeeming all the tribes?” However, many states will ignore the act and use their statutes to deny Native Americans the vote. Many Native Americans will not be allowed to vote until 1948. (Nebraska Studies 2001; American Civil Liberties Union 2012)
The US Supreme Court reverses the conviction of the “Scottsboro Boys,” nine black men from Scottsboro, Alabama, who had been convicted of raping a group of white women and sentenced to death. In the case of Powell v. Alabama, the Court finds that the men had been granted inadequate representation—they had been given a court-appointed lawyer only on the morning of their trial, and thusly that lawyer had no time to prepare an adequate defense. The case is sent back to the Alabama state court, where despite testimony from one of the alleged victims that no rape had taken place, all are convicted again. The Supreme Court will again overturn their convictions, this time because no blacks were on the jury. The nine are tried for a third time: four are convicted, one pleads guilty, and four have charges against them dropped. (PBS 12/2006)
White supremacist and ardent Nazi follower William Dudley Pelley, a New England native of what he calls “uncontaminated English stock,” founds the Silver Shirts, a neo-Nazi organization, in Asheville, North Carolina, the same day that Adolf Hitler ascends to power in Germany. Apparently Pelley funds the organization through the proceeds of a best-selling book, Seven Minutes in Eternity, in which he claimed to have died and gone to “the beyond” for a seven-minute period. Pelley and his followers, including Henry Lamont “Mike” Beach (see 1969), dress themselves in silver shirts emblazoned with a large cursive “L,” blue corduroy knickers, and gold stockings. Pelley considers himself a Republican, though he is not politically active in the usual sense.
Anti-Semitic, Anti-Government - His efforts attract members from pro-Nazi groups, Ku Klux Klan chapters, and others sympathetic to his anti-Semitic views. In August 1933, the American Jewish Committee (AJC) will warn: “The Silver Shirts came into existence the early part of this year. They are enrolling white Protestant Christians as members of a Christian militia, through a plan of State encampments that are reported to extend into various states of the Union, with posts in every community.” According to Silver Shirt documents obtained by the AJC, the group intends to bring about the establishment of a strictly Christian government in the US; accuses President Roosevelt of being a “dictator” and “set[ting] aside the Constitution, which they desire to restore”; intends to “save [the] United States from a state of Sovietism into which… the Jews are leading the country”; accuses Jews of being a “money power” bent on destroying the nation’s economy via their “control” of the Federal Reserve; and says that “a people who constitute only 2.5 per cent of the population [Jews] to be held down to a 2.5 per cent influence in the American government, and we propose to see that it is brought about, race prejudice or no!” The group also advocates a form of direct democracy, in which citizens mail in their votes for or against pending legislation, and proposes the reorganization of America into what it calls a “colossus corporation,” where “[e]very citizen shall be both a common and a preferred stockholder.”
Psychic Messages - Pelley claims to receive psychic messages from “the vastness of cosmos,” including two sets of documents, the “Esoteric Doctrines of the Liberation Enlightenment” and the “Liberation Scripts,” which set forth the “Christ government” he intends to establish. In a Silver Shirt newsletter, Pelley writes: “It is the order of things that those wicked and malignant spirits who have incarnated in certain sections of the Hebrew race trying to bring the downfall of the Christ Peoples, should meet a fearful fate in this closing of the Cycle of Cosmic Event. That contest is on-the-make and Hitler’s job it has been to do the advance work. But Hitler is not going to finish that work. THE FINISH OF IT COMES RIGHT HERE IN AMERICA!” Pelley writes that “the Jew” is possessed of a “nomadic character, making him an internationalist whose ultimate objectives may well mean the destruction and disappearance of the United States.” (American Jewish Committee 8/24/1933; Ian Geldard 2/19/1995; David Neiwert 6/17/2003)
Spike in Membership Will Dwindle - Pelley’s group will enjoy its largest membership of some 15,000 in 1934; four years later, the group will dwindle to around 5,000 members. (The Holocaust Chronicle 2009) Pelley will be convicted of sedition in 1942, and by the time he emerges from prison in 1950, his Silver Shirts will have long since disappeared.
'Christian Fascist' - In the early 1980s, graduate student Karen Hoppes will write extensively about Pelley. She will write of his Christian fundamentalism: “[T]he link with fundamental Christianity establishes the uniqueness of American fascism. The majority of fascist groups justified their existence by their desire to change the United States into a Christian society.… The relationship between the religious identity of these groups and their political demands can be shown by a careful survey of their rhetoric. The Christian fascist does not distinguish between the application of the terms anti-Christ, Jew, and Communist. Neither does he distinguish between Gentile and Christian.” (David Neiwert 6/17/2003)
The US Supreme Court, ruling in Breedlove v. Settles, finds a poll tax implemented in Georgia law to be constitutional. The Court decision effectively abrogates the right of most African-Americans in Georgia to vote, as most of them cannot pay the poll tax. The Court ruling serves to disenfranchise many African-Americans for decades. Some Southern states will employ poll taxes well into the 1960s. (PBS 12/2006; American Civil Liberties Union 2012)
The German-American Bund, the most influential pro-Nazi movement in the US prior to World War II, holds a rally in New York City’s Madison Square Garden that attracts some 20,000 participants. The rally is to protest for the rights of white Gentiles, whom the organization calls the “true patriots” of America. The Bund is led by Fritz Kuhn, an outspoken anti-Semite; at its height, the organization boasts some 25,000 members along with 8,000 “Storm Troopers.” Although the group portrays itself as patriotic Americans, even combining images of George Washington and the Nazi swastika, almost all of the members are German immigrants with ties and/or allegiances to Hitler’s Nazi movement. Public opinion polls show Kuhn is considered the most prominent anti-Semite in the nation. The party has little support outside of a few large cities. Shortly after the rally, Kuhn is investigated, found to have close ties to Germany’s Nazi Party, and eventually jailed for embezzling funds from the organization, causing many members to depart. In December 1941, the US government will outlaw the organization. (The Holocaust Chronicle 2009; US Holocaust Museum 2010; US Holocaust Museum 2010)
The Magnuson Act, also known as the Chinese Exclusion Repeal Act of 1943, repeals the Chinese Exclusion Act signed into law in 1882 (see 1882). The act is passed in part to “give face” to the US’s World War II ally, China. Congress agrees to repeal the Exclusion Act and sets a quota of Chinese immigrants who may come to the US annually. It also grants those immigrants the right to become citizens via naturalization. (Library of the University of Washington, Bothell 12/17/1943 ; Harper's Weekly 1999; University of Delaware 2006 )
The US Supreme Court upholds by a 6-3 vote the legitimacy of Executive Order 9066 issued by President Franklin Roosevelt on February 19, 1942 that mandated all Americans of Japanese heritage to report to internment camps during World War II. Writing for the Court in the case of Korematsu v. United States, Justice Hugo Black finds that an executive order based on race is “suspect,” but says that the “emergency circumstances” of wartime make the order necessary and constitutional. Forty-four years later, in 1988, Congress will formally apologize and issue monetary reparations to Japanese-American families who had been forced into the camps. (PBS 12/2006; Savage 5/24/2011) In 2011, acting Solicitor General Neal Katyal will state that his predecessor during the case, Charles Fahy, deliberately hid evidence from the Court that concluded Japanese-Americans posed no security or military threat. The report from the Office of Naval Intelligence (ONI) found that no evidence of Japanese-American disloyalty existed, and that no Japanese-Americans had acted as spies or had signaled enemy submarines, as some at the time believed. Katyal will say that he has a “duty of absolute candor in our representations to the Court.” Katyal will say that two government lawyers informed Fahy he was engaging in “suppression of evidence,” but Fahy refused to give the report to the Court. Instead, Fahy told the Court that the forced internment of Japanese-Americans was a “military necessity.” Fahy’s arguments swayed the Court’s opinion, Katyal will state. “It seemed obvious to me we had made a mistake. The duty of candor wasn’t met,” Katyal will say. (Savage 5/24/2011)
The US Supreme Court stops political parties in Texas from discriminating based on race. In the case of Smith v. Allwright, the Court rules that the Texas Democratic Party may not prohibit African-Americans from membership and from participating in primary elections. The Court bases its ruling on the Fifteenth Amendment (see February 26, 1869), and overturns its decision in the 1935 Grovey v. Townsend case. (PBS 12/2006; American Civil Liberties Union 2012)
A federal court rules in King v. Chapman that whites-only primary elections in Georgia are unconstitutional. The court rules, “The exclusions of voters made by the party by the primary rules become exclusions enforced by the state and when these exclusions are prohibited by the Fifteenth Amendment (see February 26, 1869) based on race or color, the persons making them effective violate under color of state law a right secured by the Constitution and laws of the United States within the meaning of the statute.” (American Civil Liberties Union 2012)
A federal court invalidates South Carolina’s effort to save its whites-only primary elections (see April 1, 1946). South Carolina attempted to remove federal court jurisdiction from its primaries, and save its discriminatory primary system, by repealing all of its primary laws. However, the court ruling in Elmore v. Rice invalidates the whites-only system. George Elmore, one of the plaintiffs in the case, is an African-American elector forbidden by South Carolina law from voting in the Democratic primary election. NAACP lawyer Thurgood Marshall is one of the lead attorneys for the plaintiffs. (ELMORE v. RICE 2010; American Civil Liberties Union 2012) Elmore and his family are persecuted by members of the Ku Klux Klan after the ruling. (South Carolina African American History Calendar 2007 )
Novelist and political activist Howard Fast, an avowed Communist who writes regularly for the pro-Stalinist Daily Worker, agrees to speak at a concert featuring baritone Paul Robeson and folk singer Pete Seeger. The concert is organized by a group called People’s Artists, and slated to take place at a picnic ground just north of Peekskill, New York. The concert is to benefit a group called the Civil Rights Congress, fighting for a stay of execution for six African-American youths sentenced to death in New Jersey.
Volatile Mix of Ideologies, Ethnicities - The Peekskill area is a well-known vacation place for African-Americans. The area itself is populated by large and antagonistic groups of conservatives of ethnic minority backgrounds, and leftists, most of them Jewish and many from New York City, who live in the area either all year or as summer residents. Parts of Peekskill, Fast later writes, have been “bypassed by the rush of American industrial development” and are home to large numbers of unemployed and underemployed rural Americans. Before the concert begins that evening, Fast learns that the Peekskill Evening Star has been running inflammatory editorials calling for the local populace to come out in protest at the “anti-American” and “subversive” concert—“every ticket purchased for the Peekskill concert will drop nickels and dimes into the basket of an un-American political organization… the time for tolerant silence that signifies approval is running out,” one editorial reads—and the American Legion is planning a march to “vehemently oppose” Robeson’s appearance. “Let us leave no doubt in their minds that they are unwelcome around here either now or in the future,” the local Legion chapter commander, Edward Boyle, writes in a letter published by the Evening Star. Fast reads through a week’s worth of editorials in the Evening Star, finding instances of what he calls “anti-Semitism and anti-Negroism… anti-Communism [and] anti-humanism.” (Fast 1951; Williams 3/1976; Courtney 9/5/1982)
Paul Robeson - Robeson is a vibrant figure among American leftists and radicals: the son of a runaway slave; an all-American football player at Rutgers; the first African-American to play the title role of “Othello” in a mainstream theatrical production; a world-renowned singer; and an avowed Marxist who has spent extensive amounts of time in the Soviet Union. Previously lionized by many Americans, his popularity soured when, after World War II, he began speaking out ever more forcefully in favor of the Soviet way of life, and against American capitalism and democracy. As a result, Robeson is now an extremely controversial and polarizing figure. Many perceive Robeson as author Roger Williams later describes him: “the personification of near-treasonous anti-Americanism.” (Williams 3/1976) The concert never takes place; instead, the grounds and audience are attacked by an angry, violent mob (see August 27, 1949).
The Westchester County District Attorney, George Fanelli, reports on the so-called “Peekskill Affair,” in which a concert organized by leftist groups was attacked and halted by an angry, violent mob (see August 27, 1949). According to the New York Compass, the district attorney says “that he didn’t know anything about the disorders but was sure that the concert-goers—and not the veterans or the hoodlums who attacked them—were responsible.” Fanelli later tells the Peekskill Evening Star, “The facts that I now have would indicate that the demonstration by the veterans’ associations was peaceful and orderly, and that after they disbanded the pro-Robesonites provoked the violence when Secor was stabbed by one of their number.” Fanelli uses the term “pro-Robesonites” in reference to Paul Robeson, the African-American singer and pro-Communist activist who was to headline the concert; Secor is William Secor, a mob member who suffered a flesh wound when one of his colleagues accidentally cut him with a knife. The McCarran-Walter Act repeals the racial restrictions of the 1790 Naturalization Law and grants first-generation Japanese-Americans the right to become citizens. Senator Pat McCarran (D-NV) is one of the strongest anti-Communist voices in the US Congress, and led investigations of the Roosevelt and Truman administrations. Along with Representative Francis Walter (D-PA), another outspoken anti-Communist, McCarran introduced the legislation bearing their names. Aside from granting Japanese-Americans citizenship, the law stiffens restrictions on “entry quotas” for immigrants into the US, and broadens the federal government’s power to admit, exclude, and deport “dangerous aliens” as defined by the Internal Security Act of 1950, another signature McCarran legislative success. The landmark US Supreme Court case Oliver Brown v. Board of Education of Topeka, Kansas, rules that racial segregation in public schools violates the Fourteenth Amendment. The unanimous decision overturns the doctrine of “separate but equal” education codified in the 1896 Plessy v. Ferguson ruling (see 1896). The case was argued by the Legal Defense and Educational Fund, the legal arm of the National Association for the Advancement of Colored People (NAACP). The organizations filed the suit as a challenge to the “separate but equal” doctrine, and combined five separate cases under the one Brown v. Board of Education rubric. The Supreme Court heard arguments on the case three different times in three years. In a unanimous decision, the Court finds that the “separate but equal” doctrine violates the equal protection and due process clauses of the Fourteenth Amendment, and orders desegregation “with all deliberate speed.” Chief Justice Earl Warren wants to send a powerful signal to the nation in the ruling, and works to craft a unanimous decision with no dissents or even concurrences. He writes the Court’s opinion himself, but seeks the input of the other justices in two draft opinions that he tailors into his final opinion. One of the compromises he is forced to make is to put off the question of actually implementing desegregation until a later time, inadvertently allowing many states to keep segregationist practices in place for decades. Warren says the opinion should be “short, readable by the lay public, non-rhetorical, unemotional, and, above all, non-accusatory.” Justice William O. Douglas is delighted by Warren’s opinion, and in a note to Warren, writes: “I do not think I would change a single word in the memoranda you gave me this morning. The two draft opinions meet my idea exactly. You have done a beautiful job.” Justice Harold H. Burton writes a memo to Warren reading in part: “Today I believe has been a great day for America and the Court.… I cherish the privilege of sharing in this.… To you goes the credit for the character of the opinions which produced the all important unanimity. Congratulations.” In an internal memo, Justice Felix Frankfurter writes of the practice of segregation: “That it is such has been candidly acknowledged by numerous accounts & adjudications in those states where segregation is enforced. Only self conscious superiority or inability to slip into the other fellow’s skin can fail to appreciate that.” Frankfurter says the ruling makes for “a day of glory.” Some right-wing and segregationist organizations condemn the ruling; Warren is forwarded a letter from an official of the Sons of the American Revolution claiming the ruling is attributable to “the worldwide Communist conspiracy” and that the NAACP is financed by “a Communist front.” President Eisenhower will take strong action to reduce segregation in America, but refuses to endorse the Court’s ruling. In 1967, one of the NAACP’s lead attorneys in the case, Thurgood Marshall, will go on to serve on the Supreme Court. (Library of Congress 1994; American Civil Liberties Union 2012)
A hundred and one congressmen, mostly conservative Southern Democrats, sign a document forwarded to President Eisenhower that becomes known as the “Southern Manifesto.” The document, formally entitled “The Declaration of Constitutional Principles,” is prompted by the recent Brown v. Board of Education of Topeka Supreme Court decision mandating the desegregation of American public schools, and is designed to pressure wavering Southern lawmakers into defying the Court’s decision as part of what researcher Tony Badger will later call “the massive resistance strategy so passionately advocated by the conservatives.” It is read aloud on the floor of the Senate by Walter George (D-GA), and was originally conceived by Senator Strom Thurmond (D-SC) with the assistance of his colleague Harry Byrd (D-VA), though the final version was tempered by a rewrite overseen by Senator Richard Russell (D-GA). The “Manifesto” declares that in certain instances, states are free to ignore federal laws and court decisions such as Brown v. Board. The document declares the Court decision an attempt to “substitute naked power for established law,” calls it “a clear abuse of judicial power,” and says that the states can and must defy the Court’s decision in the interest of establishing the rights of the states against the federal government. The principle of “separate but equal” treatment of white and black Americans, codified in an 1849 case and upheld by the 1896 Court decision in Plessy v. Ferguson, is, the signers state, “the established law of the land” and cannot be overturned by the current Court. It is up to the states, not the federal government, to determine if and when they will desegregate their separate school systems. Far from mandating equal treatment, the signers state, the Brown decision “destroys the amicable relations between the white and Negro races that have been created through 90 years of patient effort by the good people of both races,” and “has planted hatred and suspicion where there has been heretofore friendship and understanding.” The “judicial encroachment” of the decision must be resisted by “any lawful means,” they write. The signers conclude, “Even though we constitute a minority in the present Congress, we have full faith that a majority of the American people believe in the dual system of government which has enabled us to achieve our greatness and will in time demand that the reserved rights of the States and of the people be made secure against judicial usurpation,” and ask their supporters not to give in to the “agitators” determined to sow chaos and disorder in the name of desegregation. Disparate Group of Non-Signers - Cambridge University scholar Tony Badger will later write of the Southern lawmakers who refuse to sign the document, “The evidence from Texas, Tennessee, Florida, and North Carolina highlights the diversity of political opinion among the non-signers—from New Deal liberal to right-wing Republican ideologue—and the disparate sources for their racial moderation—national political ambitions, party loyalty, experience in the Second World War, Cold War fears, religious belief, and an urban political base.” (Badger 4/1997)
Thurmond Calls NAACP 'Professional Racist Agitators,' Says Southern Whites Are Nation's 'Greatest Minority' - After the reading, Thurmond delivers a far less measured television address, calling the organization that brought the original lawsuit, the NAACP, a group of “professional racist agitators” and saying: “All of us have heard a great deal of talk about the persecution of minority groups. The white people of the South are the greatest minority in this nation. They deserve consideration and understanding instead of the persecution of twisted propaganda.” After his speech, one Georgia woman praises Thurmond’s “courage and wisdom,” and asks: “Wouldn’t it be possible to remove much of the Negro population from the South? I sincerely wish that this might be done, and would be glad to even contribute personally to the expense of such a plan.” (Cohodas 1993, pp. 284-300)
Counterattack in Congress - In the following days, a succession of Northern Democrats lambast the manifesto on the Senate and House floor, and none of the signatories rise to speak in its defense. Wayne Morse (D-OR) says the document advocates nothing less than the “nullification” of the federal government, and if taken to its logical conclusion, the dissolution of the United States into 50 disparate entities. “If the gentlemen from the South really want to take such action,” he says, “let them propose a constitutional amendment that will deny to the colored people of the country equality of rights under the Constitution, and see how far they will get with the American people.” (Time 3/26/1956; Cohodas 1993, pp. 284-300) One Southern senator says shortly after its reading, “Now, if these Northerners won’t attack us and get mad and force us to close ranks, most of us will forget the whole thing and maybe we can pretty soon pretend it never happened.” (Time 3/26/1956) The “Manifesto” heralds a split in the Democratic Party, between conservative, segregationist “Dixiecrat” Southerners and the moderate-to-liberal remainder of the party’s lawmakers. Thurmond will lead an exodus of the segregationists from the Democratic Party to the Republican Party shortly thereafter. (Cohodas 1993, pp. 284-300)
Congress passes the Civil Rights Act (CRA) of 1957, the first such law to pass Congress since the federal civil rights laws of 1875. The law allows the US attorney general to bring suits to address discrimination and voter intimidation against African-Americans and other minorities. The CRA is the jumping-off point of successive legislative attempts to grant equal rights and protections for minority citizens. President Eisenhower was never a vocal supporter of civil rights, believing that such changes had to come from within the “heart” and not be imposed by legislation from Washington. However, he does support the CRA, and helped push it through Congress against entrenched resistance, largely but not entirely from Southern Democrats determined to protect segregationist practices even after the landmark Brown v. Board decision (see May 17, 1954). The CRA originally created a new division within the Justice Department to monitor civil rights abuses, but Senate Democrats, led by Lyndon Johnson (D-TX), worked to water down the bill in order to keep Southern Democrats and more liberal Democrats from the west and northeast from tearing the party apart along ideological lines. Johnson, along with Senator James O. Eastland (D-MS), rewrote the CRA to take much of its power away. The final version does grant new protections for African-American voters, pleasing the liberals of the Democratic Party, but contains almost no enforcement procedures for those found obstructing African-Americans’ attempts to vote, thus mollifying the conservative wing of the party. Eisenhower himself admitted that he did not understand parts of the bill. African-American leader Ralph Bunche, a prominent US diplomat, calls the act a sham and says he would rather have no bill than the CRA. But Bayard Rustin, a leader of the Congress on Racial Equality (CORE), says the bill has symbolic value as the first piece of civil rights legislation passed in 82 years. The US Supreme Court rules in Lassiter v. Northampton County Board of Elections that literacy tests for voting in North Carolina are constitutional. The case was brought by an African-American voter who argued that his right to vote was being unconstitutionally constrained. The Court rules that because the literacy test applies to all voters, it is legal (see April 25, 1898). The American Civil Liberties Union will call the ruling “a major setback to voting rights.” (PBS 12/2006; American Civil Liberties Union 2012)
The “Christian Identity” theology, formerly a fairly benign expression of what is known as “British-Israelism” or “Anglo-Israelism,” begins to spread throughout the US and Canada, particularly on the west coasts of these nations. This belief holds that white Americans and Canadians are the real descendants of the Biblical tribes of Israel. In 2003, author Nicole Nichols, an expert on far-right racist and religious groups in America, will define the concept of “Christian Identity” as practiced by many white supremacist and separatist groups. Christian Identity is not an organization, she will write, but an ideology that many organizations have adopted in some form or fashion. Christian Identity “elevates white supremacy and separatism to a Godly ideal,” she will write, calling it “the ideological fuel that fires much of the activity of the racist far right.” According to Christian Identity theology, Jews are neither the “true Israelites” nor the true “chosen people” of God; instead, Christian Identity proponents claim, Jews are descended from an Asiatic people known as the Khazars, who settled near the Black Sea during the Middle Ages. (Nicole Nichols 2003; Anti-Defamation League 2005; Ontario Consultants on Religious Tolerance 5/30/2006) In 2005, the Ontario Consultants on Religious Tolerance will write, “Followers tend to be involved in political movements opposing gun control, equal rights to gays and lesbians, and militia movements,” and quote Michael Barkun, an expert on radical-right groups, as saying, “This virulent racist and anti-Semitic theology… is prevalent among many right-wing extremist groups and has been called the ‘glue’ of the racist right.” (Ontario Consultants on Religious Tolerance 5/30/2006)
Beginnings; 'The Protocols of the Elders of Zion' - In the 1920s, William J. Cameron, editor of the Dearborn Independent weekly newspaper, popularized the anti-Semitic hoax manuscript called “The Protocols of the Elders of Zion,” which purported to detail the “secret teachings” of Judaism, including the planned takeover of the world’s governments, the subjugation of non-Semitic races, and the bizarre, cannibalistic rituals supposedly practiced by Jews. (Anti-Defamation League 2005)
Wesley Swift and 'Mud People' - In the 1940s, a former Methodist minister, Wesley Swift, started his own church, later known as the Church of Jesus Christ Christian. Swift had deep ties to a number of radical right-wing groups including the Ku Klux Klan; Swift and his associates set the stage for the mutation of the Christian Identity into a loosely organized set of virulently anti-Semitic, racist belief systems that will come to be grouped together under the “Christian Identity” rubric. Swift himself taught that only the white race was created in the form of God, while Asian and African races were created from the “beasts of the fields,” and thusly are subhuman creations. In Swift’s version of Genesis, Eve, the wife of the first “true” man Adam, was seduced by The Serpent, who masqeueraded as a white man. Eve bore a son, Cain, who is the actual father of the Jewish people. This reinterpretation, sometimes called the “two-seed” or “seedliner” theory, supports the Christian Identity propensity to demonize Jews, whom Swift and others labeled the “spawn of Satan.” Today’s white Europeans and their American and Canadian descendants, Swift taught, are descended from the “true son” of Adam and Eve, Abel, and are the actual “chosen people” of God. Some Christian Identity adherents go even farther, claiming that subhuman “pre-Adamic” races existed and “spawned” the non-white races of the world, which they label “mud people.” (Nicole Nichols 2003; Anti-Defamation League 2005)
Permeates Racist, Far-Right Groups - By the 1960s, a new group of Christian Identity leaders emerges to spread the Identity theology through the radical, racist right in America and Canada, popularizing the once-obscure ideology. Most prominent among them are three disciples of Swift: James K. Warner, William Potter Gale, and Richard Butler. Warner, who will move to Louisiana and play a leading role in the fight against civil rights, founds the Christian Defense League and the New Christian Crusade Church. Gale, an early leader of the Christian Defense League and its paramilitary arm, the California Rangers, goes on to found the Posse Comitatus (see 1969), the group that will help bring about the sovereign citizen movement. Gale will later found the Committee of the States and serve as the “chief of staff” of its “unorganized militia.” Butler moves Swift’s Church of Jesus Christ Christian to Idaho and recasts it as the neo-Nazi group Aryan Nations (see Early 1970s). Under the leadership of Butler, Gale, Warner, and others, Christian Identity soon permeates most of the major far-right movements, including the Klan and a racist “skinhead” organization known as the Hammerskins. It also penetrates many extreme anti-government activist groups. The Anti-Defamation League will write, “The resurgence of right-wing extremism in the 1990s following the Ruby Ridge (see August 31, 1992) and Waco standoffs (see April 19, 1993) further spread Identity beliefs.” (Anti-Defamation League 2005) Nichols will write: “Christian Identity enclaves provide a trail of safe havens for movement activists, stretching from Hayden Lake in northern Idaho (the Aryan Nations stronghold) to Elohim City on the Oklahoma/Arkansas border (see 1973 and After). Many white supremacists on the run from federal authorities have found shelter and support from Christian Identity followers.” Some organizations such as the Montana Militia are headed by Identity adherents, but do not as a group promote the theology. (Nicole Nichols 2003; Anti-Defamation League 2005)
Bringing Forth the Apocalypse - Many Christian Identity adherents believe that the Biblical Apocalypse—the end of the world as it is currently known and the final ascendancy of select Christians over all others—is coming soon. Unlike some Christians, Identity adherents do not generally believe in the “rapture,” or the ascendancy of “saved” Christians to Heaven before the Apocalypse ensues; instead, Identity followers believe Jesus Christ will return to Earth only after the time of the “Tribulation,” a great battle between good and evil, which will set the stage for the return of Christ and the final transformation of the world. Identity followers believe it is their duty to prepare for the Apocalypse, and some believe it is their duty to help bring it about. They tend to cast the Apocalypse in racial terms—whites vs. nonwhites. Identity adherents believe that worldly institutions will collapse during the “end times,” and therefore tend to distrust such institutions, making Identity theology appealing to anti-government ideologies of groups such as militia, “Patriot,” and sovereign citizens groups. 21st Century Identity - In the 21st century, Christian Identity groups are strongest in the Pacific Northwest of America and Canada, and the US Midwest, though Identity churches can be found throughout the US and in other parts of Canada. Identity churches also exist in, among other nations, Ireland, Great Britain, Australia, and South Africa (see June 25, 2003). The Anti-Defamation League will write: “Yet while spread far it is also spread thin. Estimates of the total number of believers in North America vary from a low of 25,000 to a high of 50,000; the true number is probably closer to the low end of the scale. Given this relatively small following, its extensive penetration of the far right is all the more remarkable.” (Anti-Defamation League 2005)
Identity Violence - Identity adherents commit a number of violent acts, often against government and/or financial institutions, in an outsized proportion to their small numbers. In 1983, Identity adherent Gordon Kahl kills two US Marshals who attempt to arrest him on a parole violation, and kills an Arkansas sheriff before finally being gunned down by authorities (see February 13, 1983 and After). The white supremacist terrorist group The Order (see Late September 1983) contains a number of Identity members, including David Tate, who kills a Missouri Highway Patrol officer while attempting to flee to an Identity survivalist compound (see April 15, 1985). During the 1980s, small Identity groups such as The New Order (or The Order II) and the Arizona Patriots commit bombings and armored car robberies. After the Oklahoma City bombing (see 8:35 a.m. - 9:02 a.m. April 19, 1995), Identity minister Willie Ray Lampley attempts a number of bombings (see November 9, 1995). In 1996, the Montana Freeman, led by Identity members, “stands off” federal authorities for 81 days (see March 25, 1996). Between 1996 and 1998, Eric Robert Rudolph, who has connections to Identity ministers such as Nord Davis and Dan Gayman, bombs an Atlanta gay bar (see February 21, 1997), several abortion clinics (see October 14, 1998), and the Atlanta Summer Olympics (see July 27, 1996 and After). In 1999, Identity member and former Aryan Nations security guard Buford Furrow goes on a shooting spree at a Jewish community center in Los Angeles (see August 10, 1999). Congress passes the Civil Rights Act of 1960. This legislation goes somewhat farther than its 1957 predecessor (see August 29, 1957). It requires election officials to have all records relating to voter registration and permits the Department of Justice to inspect them, making it more difficult for white interests to oppress African-American voters. Additionally, the law allows African-Americans barred from voting to apply to a federal court or voting arbitrator to gain those rights. Like its predecessor, it was ushered through by President Eisenhower, who pushed for the bill after an outbreak of violence against African-American churches and schools throughout the South in late 1958. And as with the first bill, Southern legislators line up in opposition to it, calling it an unacceptable interference in states’ affairs by the federal government. The second Civil Rights Act is not a major enhancement for voting-rights protections, and many critics call it little more than a sop to engage African-American voters in the 1960 elections. The new bill does provide for the creation of a Civil Rights Commission in the Justice Department, a provision that was eliminated from the 1957 bill. (American Civil Liberties Union 2012)
A Time magazine profile lambasts the racist, anti-Communist John Birch Society (JBS—see December 2011), in what is many Americans’ first exposure to the group. It delineates the organization’s penchant for secrecy, its domination by its “dictatorial” leader, Robert Welch, and its hardline battle against almost every element of the federal government as “agents of Communism.” Forty to 60 percent of the federal government is controlled by Communism, the JBS believes. Time calls the organization “a tiresome, comic-opera joke” that nonetheless has cells in 35 states and an ever-widening influence. In Wichita, Kansas, JBS student members are trained to inform their cell leaders of “Communist” influences they may detect in their classroom lectures, and the offending teacher is berated by parents. A Wichita businessman who wanted to give a donation to the University of Wichita decided not to donate after being hounded by local JBS members, who wanted the university to fire professors and remove selected books from its library. “My business would be wrecked,” the businessman explains, “if those people got on the phone and kept on yelling that I am a Communist because I give money to the school.” Nashville, Tennessee, JBS members organize community members to verbally attack neighbors whom they suspect of Communist affiliations. JBS’s current priority, Time writes, is to bring about the impeachment of Chief Justice Earl Warren. Welch, who obtained his wealth from his brother’s candymaking business, believes that Social Security and the federal income tax are all part of the “creeping socialism” that is taking over the federal government. He retired from the business in 1957 and founded the JBS shortly thereafter, naming it for a US Navy captain killed by Chinese Communist guerrillas after the end of World War II. Welch’s seminal tract, “The Politician,” accuses President Eisenhower and his brother Milton Eisenhower of being Communist plants, and accuses both men of treason against the nation. (Time 3/10/1961)
In a landmark ruling, the US Supreme Court, in the case of Baker v. Carr, finds that courts can order state legislatures to redraw district boundaries to ensure citizens’ political rights. The case pertains directly to Tennessee, which still uses 60-year-old district boundaries that give minorities less representation than would be the case if districts were redrawn to more equally represent populations. Hence, Tennessee has an outsized white majority in its state legislature. The Court rules that courts can order such districts to be redrawn. The ruling is a major advancement for minority voting rights. (American Civil Liberties Union 2012)
The US Supreme Court, in the case of Gray v. Sanders, rules that Georgia’s “county unit” system of voting is unconstitutional, and codifies the concept of “one person, one vote.” Georgia’s “county unit” voting system is unfairly weighed to maximize votes from largely white rural areas and to dilute votes from urban districts with larger minority populations. Georgia voter James Sanders brought a suit challenging the system; his suit named James H. Gray, the chairman of the State Executive Committee of the Democratic Party, as one of the defendants. The Court agreed to hear this case though it had refused to hear previous challenges to the “county unit” system in the past. The Court rules 8-1 that the system violates the Fourteenth Amendment, which grants equal protection under the law. In the majority opinion, Justice William O. Douglas writes, “The conception of political equality from the Declaration of Independence, to Lincoln’s Gettysburg Address, to the Fifteenth, Seventeenth, and Nineteenth Amendments can mean only one thing—one person, one vote.” The lone dissenter, Justice John Marshall Harlan II, says the case should be sent back to lower courts for retrial. Conservative segregationist George Wallace (D-AL) says of the civil rights movement and the accompanying unrest, “There’s nothing wrong with this country that we couldn’t cure by turning it over to the police for a couple of weeks.” (Hunt 9/1/2009, pp. 16) (Some sources will cite this statement as having been made in 1967.) The transformative Civil Rights Act of 1964 passes Congress. The law makes it illegal to discriminate on the basis of race, national origin, religion, or gender in voting, public places, the workplace, and schools. Former President John F. Kennedy had argued for new civil rights legislation, saying that previous legislative efforts (see August 29, 1957 and May 6, 1960) did not go far enough. Kennedy waited until 1963 to send his legislation to Congress, and was assassinated before the bill was passed. On June 11, 1963, Kennedy told the public, “The negro baby born in America today, regardless of the section of the nation in which he is born, has about one-half as much chance of completing high school as a white baby born in the same place on the same day; one-third as much chance of completing college; one-third as much chance of becoming a professional man; twice as much chance of becoming unemployed; about one-seventh as much chance of earning $10,000 a year; a life expectancy which is seven years shorter; and the prospects of earning only half as much.” His successor, Lyndon Johnson, a conservative Southern Democrat, surprised many by pushing the bill instead of falling in line with conservative Southern Democrats who opposed it. Johnson and Senate leaders successfully fought back a filibuster by Senator Richard Russell (D-GA) and 17 other segregationist Democratic senators who tried to derail the bill; it passed the Senate on a 73-24 vote. Some believe that the passage of the bill is one of the major legislative acts that drives many Southern Democrats to leave the party for the increasingly conservative venue of the Republican Party. The word “sex,” to prohibit gender-based discrimination, was added to the legislation at the last minute by Representative Howard W. Smith (D-VA), and some accused Smith of inserting the provision as a means to kill the entire bill. Smith argued that he was supportive of efforts by women’s rights organizations, and inserted the language in a sincere effort to curb discrimination against women. Smith is joined by Representative Martha W. Griffiths (D-MI) in keeping the provision in the bill. Perhaps the most significant provision of the bill is the creation of the Equal Employment Opportunity Commission (EEOC), charged with implementing the law. The EEOC will use the practice of “affirmative action” to curb discrimination, including mandating hiring of minorities and women to alleviate many employers’ practice of hiring white males almost exclusively, especially for more senior positions. President Johnson will extend his support to “affirmative action,” and is perhaps the first public figure to use the phrase in addressing the public. A federal grand jury in Jackson, Mississippi, indicts 19 Ku Klux Klan members and others for the 1964 murders of three civil rights workers, James E. Chaney, Andrew Goodman, and Michael Schwerner. The indictments mark the first time in Mississippi history that white men have faced serious charges for committing race-related crimes. Deputy Sheriff Cecil Price will be sentenced to six years in jail. KKK leader Sam Bowers and KKK member Wayne Roberts will receive 10 years apiece. (American Civil Liberties Union 2012) Investigators conclude that Bowers, the Imperial Wizard of the White Knights of the Ku Klux Klan of Mississippi, instigated the murders of Chaney, Goodman, and Schwerner. Klan members had attempted to kidnap Schwerner on June 16, 1964, but when they were unable to find him, instead set fire to a black church and systematically beat a group of black churchgoers. Schwerner, along with Chaney and Goodman, were in Ohio at the time and returned to Mississippi after hearing of the incident. Both Price and his superior, Neshoba County Sheriff Lawrence Rainey, are members of the KKK, and have a reputation for being “tough” on blacks, and officials of the Congress of Racial Equality (CORE), the organization that sponsors the three civil rights workers, were worried about their safety. On June 21, while asking about the fire and the beatings, the three workers were notified that a group of white men was looking for them. They were arrested by Price while driving to the CORE offices in Meridian, allegedly on suspicion of being involved in the church arson, and taken to the Neshoba County jail. Price met with KKK recruiter (kleagle) Edgar Ray Killen to discuss what to do with the three. Price and the other police officers pretended to release the three, and let them drive away, but Price followed them in his police cruiser. Price pulled the car carrying the three over, placed them in his police cruiser, and drove them down a lonely dirt road, followed by at least a dozen Klan members. The three were beaten by the various Klan members, then shot to death by Klan member Wayne Roberts. The bodies were taken to a dam site at a nearby farm and buried under tons of dirt by earthmoving equipment. It is almost certain that Price informed Rainey of the murders and the burials upon returning to his office. Justice Department and FBI agents began investigating the disappearance of the three workers (giving the case the name “Mississippi Burning,” or MIBURN), and soon found the burned-out hulk of the station wagon driven by Chaney during the three’s final moments. Federal agents found it difficult to find witnesses willing to talk, but FBI agent John Proctor found that children were often knowledgeable and willing to speak in return for candy. A $30,000 reward offering led agents to the buried bodies. Informants from within the Klan itself finally broke open the case, particularly John Jordan, a Meridian speakeasy owner who cooperated with agents rather than face a long prison term. In December 1964, 19 men, including Price, Bowers, Roberts, and Killen, were arrested and charged under Mississippi law. Initially, a US commissioner threw out all of the charges against the 19, claiming that no evidence linked them to the crimes, but the 19 will be charged under federal laws instead. Segregationist Judge William Harold Cox will again dismiss the charges against all but Rainey and Price, but the US Supreme Court will reinstate the charges in February 1966. Cox will impose the extraordinarily lenient sentences, and will later say, “They killed one n_gger, one Jew, and a white man—I gave them all what I thought they deserved.” Price will only serve four years of his sentence before rejoining his family in Philadelphia, Mississippi. In 1999, Mississippi will reopen the investigation, and in 2005 will reindict Killen, who escaped conviction in the first trial because of the jury’s refusal to “convict a preacher.” Killen will be sentenced to 60 years in jail on three counts of manslaughter. Over 500 non-violent civil rights marchers are attacked by law enforcement officers during a march from Selma to Montgomery, Alabama. The attack takes place while the marchers are crossing the Edmund Pettus Bridge outside of Selma. The march is to protest the disenfranchisement of African-American voters, and to protest the fatal police shooting of civil rights activist Jimmy Lee Jackson. The marchers are badly beaten by police officers and white residents wielding billy clubs and tear gas, and driven back into Selma. The marchers heed the non-violent teachings of Dr. Martin Luther King Jr. and other civil rights leaders, and refuse to counterattack. The attack, later termed “Bloody Sunday,” is shown on national television, sparking a national outcry. Two days later, King will lead a symbolic march to the bridge, and he and other civil rights leaders will secure court protection for a third, large-scale march from Selma to Montgomery. A week later, President Lyndon Johnson will denounce the attack as “deadly wrong.” On March 21, King will lead some 3,200 marchers from Selma to Montgomery, reaching the capitol on March 25. By the time they reach Montgomery, the number of marchers will have grown to around 25,000. The attack helps spur the passage of the Voting Rights Act (VRA—see August 6, 1965). President Lyndon Johnson signs the Voting Rights Act (VRA) into law. Based on the Fifteenth Amendment (see February 26, 1869), the VRA is a potent set of statutes that permanently bars direct barriers to political participation by racial and ethnic minorities. It bans any election practice that denies the right to vote due to race, and requires areas with a history of racial discrimination to get federal approval of changes in their election laws before they can take effect. The VRA forbids literacy tests (see 1896, April 25, 1898, and June 8, 1959) and other barriers to registration that have worked to stop minority voters from exercising their rights (see 1888, June 21, 1915, and February 4, 1964). Sections 2 and 5 of the VRA work together to prohibit states from establishing voting qualifications or standards that interfere with a citizen’s right to vote on a racial basis. Section 5 requires states with a history of racial discrimination to obtain “preclearance” from the Justice Department before altering any laws pertaining to voting—this includes changing electoral districts, voter qualification rules, and even changes in government structure such as making a formerly elective office appointive. If the changes can be seen as possibly “diluting” minority voting strength, they can be disallowed. States wishing to challenge the VRA restrictions have the opportunity to have their cases heard in federal court. Section 2 has similar, if less restrictive, provisions that apply nationally. Section 10 of the VRA takes direct aim at the Breedlove ruling from the Supreme Court (see December 6, 1937), which had legitimized poll taxes used to disenfranchise minority voters. That portion of the VRA finds that poll taxes “impose… unreasonable financial hardship” and “precludes persons of limited means from voting.” The VRA also forbids the use of literacy tests, good character tests, and other such tests used in the past to suppress minority voting. The law urges the attorney general to urge the Court to overrule Breedlove; minutes after Johnson signs the bill into law, he directs the attorney general “to file a lawsuit challenging the constitutionality of the poll tax.” The Court will find poll taxes unconstitutional in its Harper v. Virginia Board of Elections ruling (see March 24, 1966). The US Department of Justice and the federal courts now have the power to monitor problem jurisdictions and assist private citizens in seeking redress through the courts if their voting rights are infringed. The US Supreme Court, in the case of Harper v. Virginia Board of Elections, finds Virginia’s law upholding “poll taxes” to be unconstitutional. The 7-2 decision finds that poll taxes—fees demanded of voters, which have been used for over a century to disenfranchise minority voters (see February 4, 1964 and December 6, 1937)—violate the Constitution by imposing discriminatory restrictions on voting. Justice William O. Douglas writes the majority opinion, with Justice Hugo Black and John Marshall Harlan II dissenting. Douglas cites the landmark Brown v. Board decision (see May 17, 1954) and the recently passed Voting Rights Act (see August 6, 1965) in his ruling. (Legal Information Institute 2011)
An FBI document covering the civil rights protest movement says in part, “Negro youths and moderates must be made to understand that if they succumb to revolutionary teaching, they will be dead revolutionaries.” (Hunt 9/1/2009, pp. 16)
Roger Ailes, the media consultant for the Richard Nixon presidential campaign, decides that Nixon should, during a televised town hall, take a staged question from a “good, mean, Wallaceite cab driver.” Ailes is referring to the overtly racist third-party candidacy of Governor George Wallace (D-AL). Ailes suggests “[s]ome guy to sit there and say, ‘Awright, Mac, what about these n_ggers?’” According to Nixonland author Rick Pearlstein, the idea is to have Nixon “abhor the uncivility of the words, while endorsing a ‘moderate’ version of the opinion.” (Pearlstein 5/2008, pp. 331; Media Matters 7/22/2011) The suggestion is not used. Ailes will go on to found Fox News (see October 7, 1996).
Deputy Attorney General Richard Kleindienst, discussing the “subversion” of the antiwar and civil rights protest movements, says: “When you see an epidemic like this cropping up all over the country—the same kind of people saying the same kind of things—you begin to get a picture that it is a national subversive activity.… All of these student protesters should be rounded up and put into detention camps.” (Hunt 9/1/2009, pp. 17)
President Nixon’s speechwriter, Pat Buchanan, writes a memo urging Nixon not to visit “the Widow King”—his term for civil rights leader Dr. Martin Luther King Jr.‘s wife Coretta Scott King—on the first anniversary of her husband’s assassination. Buchanan writes that a visit would “outrage many, many people who believe Dr. King was a fraud and a demagogue and perhaps worse.… Others consider him the Devil incarnate. Dr. King is one of the most divisive men in contemporary history.” The memo will be publicly revealed in the 1980s. (Fairness and Accuracy in Reporting 2/26/1996)
Congress renews the Voting Rights Act of 1965 (VRA—see August 6, 1965) for five more years. Unfortunately, the law’s provisions are temporary. Congress also finds that many states are purposefully ignoring some provisions of the law. In the hearings about the law’s extension, Congress heard about the many ways voting electorates were manipulated through gerrymandering, annexations, at-large elections (see April 22, 1980), and other methods to disenfranchise minority voters. Aerospace engineer and white racist Richard Butler, who departed California in the early 1970s and moved into a rural farmhouse in Hayden Lake, Idaho, founds and develops one of the nation’s most notorious and violent white separatist groups, the Aryan Nations. Butler’s 20-acre farmhouse becomes the compound for the group and its affiliated church, the Church of Jesus Christ Christian; Butler and his nascent organization envision a “whites-only” “homeland” in the Pacific Northwest. At age 11, Butler read a serialized novel in Liberty Magazine, depicting the takeover of the US by “race-mixing Bolsheviks” that deeply impressed him. As a young man, he worked as an aeronautical engineer in India, where he was fascinated by the Indian caste structure and the concept of racial purity. In 1941 he left a Los Angeles church after concluding that the preacher was spreading Communist doctrine. During World War II, as an Army engineer, he became fascinated by the German military, and later recalls that he “was thrilled to see the movies of the marching Germans.… In those days, all we knew was that Hitler hated communists, and so did my folks—as we did as teenagers.” In the 1950s, Butler was enthralled by radio broadcasts of then-Senator Joseph McCarthy (R-WI) and his “Red scare” accusations, and sent money to support McCarthy’s political campaigns. During that time, Butler met William Potter Gale, another white supremacist who went on to found the Posse Comitatus (see 1969). Butler held a high position in the Christian Defense League, an organization founded by the Reverend Wesley Swift and described by the Southern Poverty Law Center (SPLC) as “virulently anti-Semitic,” until 1965, and shortly thereafter became a mail-order “ordained minister” of Christian Identity, a white supremacist offshoot of the Christian church (see 1960s and After). Butler buys the farmhouse in Hayden Lake and founds his own “Christian Posse Comitatus,” and thereafter founds the Church of Jesus Christ Christian. The two groups merge into what later becomes known as Aryan Nations. (Cooperman 6/2/2003; Southern Poverty Law Center 2010; Southern Poverty Law Center 2010)
The first African-American candidate to successfully run for office in Leon County, Florida, is James Ford, a vice principal running for the Tallahassee city commission. The Tallahassee Democrat gives a qualified endorsement to Ford, saying that he is a “mature Negro” and going on to say: “We are impressed that he may be the best-qualified Negro ever to offer for public office in Tallahassee. We would expect him to serve, if elected, as a proper representative of his racial minority without antagonistic attitudes towards the majority that might result in more frustration and discord than genuine advancement.” (Tapper 3/2001)
President Nixon explodes in fury at a Jewish Department of Labor official’s statement to the press about unemployment rates going up. After a tirade about “Jew c_cks_cker[s]” being “radical left-wingers,” “untrustworthy,” and “disloyal,” Nixon orders a study of the number of Jews in that particular Labor Department bureau. “Thirteen of the 35 fit the demographic[s],” the answer reads. (Reeves 2001, pp. 343-344)
The US Supreme Court overturns Tennessee’s “Duration Residency” law that prohibits some residents from voting. In the case of Dunn v. Blumstein, Tennessee’s law requiring voters to live in the state for a year before voting, and in a given county for 90 days before voting, is challenged. Tennessee law requires voters to register 30 days before an election in order to vote in that election, but has more stringent residency requirements. A lower court held the law unconstitutional because it interfered with a citizen’s right to vote and created what the court called a “suspect” classification of citizens, resulting in some Tennessee residents being unfairly penalized. Tennessee’s position is that the requirements are needed to ensure the integrity of voting, and to ensure that voters are knowledgeable about what they are voting on. The Supreme Court finds that the “durational residency” requirements violate the Equal Protection Clause of the Fourteenth Amendment. Mark James “Jimmy” Robert Essex, a 23-year-old African-American who served as a dental technician in the US Navy (and was stationed in California while many of his fellow soldiers were serving in Vietnam), launches a killing spree in New Orleans that results in nine dead and 13 wounded.
History of Racial Complaints, Membership of Extremist Group - Essex is apparently driven by racism and anger over what he considers to be personal and historical slights; while stationed in San Diego, he filed numerous complaints about being treated unfairly due to his race, and was disciplined several times for engaging in fights with white sailors. While in the Navy, Essex became interested in the Black Panthers, and befriended a fellow recruit, a Black Muslim who had a record of violent crime before entering the service. A friend of Essex’s in the Navy later recalls Essex changing drastically, “in a matter of weeks,” after meeting his new friend. Essex was court-martialed for going AWOL (absent without leave), and told the court during the proceedings, “I had begun to hate all white people.” He was discharged with a diagnosis of “character and behavior disorders,” and went to New York City for a time, where he immersed himself in a chapter of the Black Panthers and the members’ revolutionary, violent rhetoric. He rejoined his Navy friend in New Orleans in August 1972, where he has lived until now.
Spree Begins - In preparation for the spree, Essex carries a .38 revolver with the serial number removed, a Ruger .44 Magnum carbine rifle, a gas mask, firecrackers, lighter fluid, and ammunition. Essex begins his spree by hiding in a parking lot close to the New Orleans Police Department, and with the Ruger shoots two police officers, Cadet Alfred Harrell and Lieutenant Horace Perez. Harrell, an African-American, dies, while Perez survives his wounds. Essex misses his intended target, Cadet Bruce Weatherford. Harrell is the only African-American Essex shoots. It is impossible to know if Essex deliberately fires on a fellow African-American or simply does not recognize Harrell’s race. As the police respond to the shooting, Essex sets off diversionary firecrackers, jumps a chain-link fence, and flees, accidentally dropping the revolver, the gas mask, and some ammunition. He then breaks into a warehouse, setting off a silent alarm. Essex waits quietly for the police to respond to the break-in. Two officers respond. One, Edwin Hosli, receives a Ruger bullet in the back as he steps out of his car. His partner returns fire and calls for backup. The police swarm over the warehouse, but Essex has already fled. Hosli will die of his wounds two months later. Evidence shows that Essex may have been wounded by gunfire, or had cut himself on broken glass. The police discover clothing, a filter canister for a gas mask, 50 .38-caliber shells, and three unfired .44 magnum cartridges. The hunt for Essex leads into a poor, predominantly African-American area of the city known as Gert Town. Some of the officers theorize that the shooter deliberately dropped the three .44 cartridges to lead them into Gert Town, a theory bolstered by their subsequent discovery of a “trail” of cartridges. They follow the trail to the deserted Saint Mark Baptist Church. Detective Emmett Dupas later tells a writer: “It was clear that it was a trap, that we were being set up. The bullets were always in pairs and always pointed in the same direction.” (Noe 7/11/2011; New Orleans Times-Picayune 12/16/2011; Hustmyre 2012)
Dodging the Police - While planning how best to enter the church without exposing themselves to the shooter’s fire, the officers learn that Chief of Police Clarence Giarrusso has called off the search. Throughout the night and the early morning, Giarrusso’s office has received numerous complaints from residents about the heavy police presence in Gert Town, and the sometimes-harsh search methods being used, with officers kicking in doors and searching homes without warrants. That evening the church pastor spots Essex inside the church and runs to a neighbor’s house to call the police. By the time police arrive, Essex is gone. On January 2, about 6 p.m., Essex enters a grocery store near the church, wearing a bloodied bandage on his left hand. He buys lipstick and makeup and departs; the store owner, suspicious because of the number of news reports about the escaped shooter, alerts the police. The police are unable to find Essex. During the evening of January 3, the police respond to a tip that the shooter is hiding inside another church in Gert Town. The police fail to find Essex, but they do find a bag of .38-caliber cartridges and a note, later proven to have been written by Essex, apologizing to the pastor for breaking into the church. On the morning of January 7, Essex returns to the store, shoots the owner, and flees in a stolen car.
Howard Johnson's - Essex hides in a parking garage adjacent to a Howard Johnson’s Hotel near City Hall and other government buildings, and gains access to the hotel’s 18th floor through a door that has been propped open. He frightens three black housekeepers, but tells them not to worry, that he is only hunting whites. He runs across Dr. Robert Steagall and Steagall’s wife Betty; Steagall attempts to stop Essex, but after a brief struggle for the weapon, Essex shoots Dr. Steagall in the chest and then Mrs. Steagall in the back of the head, killing them both. He uses his lighter fluid to set the Steagalls’ room on fire, and drops a black, green, and red African flag on the floor beside the two. He then breaks into the 11th floor via the stairwell, and sets fires in empty rooms all along the corridor. Essex kills assistant manager Frank Schneider on the 11th floor. As smoke billows out of the hotel window and the switchboard lights up with calls about an armed man in the hallway, Essex goes to the 10th floor, where he shoots and kills hotel general manager Walter Collins. As police and firemen respond to the reports, Essex, now on the 8th floor, shoots hotel guest Robert Beamish while Beamish is standing next to the pool far below. Beamish survives the gunshot. Essex, setting more fires on the 8th floor, spots fireman Tim Ursin climbing a ladder to the 11th floor, and shoots him in the forearm. Policeman Bill Trapagnier, climbing behind Ursin, returns fire. New Orleans police surround the hotel, many of them carrying personal weaponry. (TruTV writer Chuck Hustmyre will later explain that the New Orleans Police Department, like most urban police departments, has not yet implemented what will come to be known as SWAT teams, so the police lack high-powered weaponry and body armor.) Essex fires at the officers from his perch on the 8th floor, earning cheers from some of the onlookers when he shoots. Essex wounds Officer Ken Solis in the shoulder and Sergeant Emanuel Palmisano in the arm and back while Palmisano tries to help Solis. He kills Officer Philip Coleman with another head shot while Coleman is also attempting to help Palmisano and Solis. And, after climbing to the 16th floor, he shoots Officer Paul Persigo in the head, killing him instantly. He also wounds an ambulance driver and a fire chief.
Command Post - Giarrusso, now on site, sets up his command post in the Howard Johnson’s lobby, forcing his officers to run a “gauntlet” of police and sniper gunfire to enter and exit the post. Deputy Police Chief Louis Sirgo assembles a team of five volunteers to rescue two officers trapped in an elevator near the top of the hotel. Essex is waiting on the 16th floor for them. When they arrive, Essex kills Sirgo with a shot to the spine and flees to the hallway. He mounts the roof. Police in the command post are beside themselves, and many think they are facing a team of assailants, not a single lone gunman. Erroneous reports flood the police airwaves, some claiming that as many as three shooters are in the hotel and that they have hostages. Giarrusso orders another group of officers up the stairwells, to locate and isolate the shooter(s) and, if possible, to force him or them onto the roof. One group of officers reaches the rooftop, and smashes its way through the locked door. Essex is waiting. He shoots Officer Larry Arthur in the stomach; Arthur manages to return fire before collapsing, though his shotgun blast misses Essex. More officers rush the roof. Giarrusso wants to secure the roof before nightfall if possible, but twilight is already coming.
Helicopter - Marine Corps Lieutenant Colonel Chuck Pitman volunteers to fly a Coast Guard helicopter into the area. Pitman, a Vietnam veteran recuperating from a leg wound suffered in combat, takes two Marine sergeants armed with M-14 rifles with him for protection. By the time they are airborne, it is entirely dark and the hotel shrouded in fog. Giarrusso sends a group of armed volunteers with Pitman into the helicopter. By this time, Essex is somewhat pinned down by Officer Antoine Saacks, an ex-Marine who has brought an M-16 with a thousand rounds of ammunition and has trapped Essex behind the protection of a cinderblock cubicle wall. Saacks asks permission to go up with Pitman and drop onto the roof, but Giarrusso refuses to allow him to drop out of the copter. Instead, Pitman and the heavily-armed police officers, including Saacks, ascend beside the roof. Pitman uses a spotlight to search the roof, while Saacks and the other sharpshooters rake the roof with gunfire. They lay down so much fire that Saacks actually expends all one thousand rounds of ammunition, and they are forced to return for more ammunition before going up a second time and them a third time. Meanwhile, Essex is returning fire, accurately; the helicopter takes several hits. Finally Saacks determines that the sniper is using a metal water pipe to move back and forth from the protection of the cinderblock alcove to another spot on the roof where he can shoot. Saacks and the other police officers pour fire into the water pipe, causing it to split open.
Killed by a Hail of Gunfire - The gunfire flushes Essex onto the roof, where the searchlight spots him as he snaps off return fire at the helicopter. “I saw him come out of the dark,” Pitman later recalls. Essex fires a bullet directly at Pitman, but strikes the transmission housing instead. The helicopter hovers 10 feet off the roof and less than 50 feet from Essex as Saacks reloads for the final exchange. “I just walked the bullets right into him,” Saacks later recalls. Saacks’s gunfire is joined by fire from other officers, including a group that has reached the roof. Essex is killed by the onslaught of gunfire; over 200 bullet wounds are later counted. One sniper later recalls that the medical team had to use “a scooper” to remove Essex’s remains.
'Shrine' of Racial Hatred - Police continue to hunt into the next day for Essex’s presumed cohorts, but find nothing. Police eventually identify Essex, and break into his apartment, to find what Hustmyre later terms “a shrine dedicated to his hatred.” Racist graffiti covers his wall space, with the words “hate” and “kill” repeated over and over again. Police find Muslim and Black Panthers newsletters, a copy of the book Black Rage, and a map with the locations of the police department and the Howard Johnson’s Hotel circled. Trapagnier will be one of a number of officers still unsure that Essex operated on his own. He later tells a Times-Picayune reporter, “My gut feeling is, I shot at two different people.”
Warning Letter - The New Orleans television station WWL turns over a handwritten note Essex had sent it sometime in late December. Station personnel had not opened the letter until January 6, the day before Essex’s spree, and had not realized the note was connected with the shootings until afterwards. The police crime lab later proves the note was written by Essex. It reads in its entirety: “Africa greets you. On Dec. 31, 1972, aprx. 11 p.m., the downtown New Orleans Police Department will be attacked. Reason—many, but the death of two innocent brothers will be avenged. And many others. P.S. Tell pig Giarrusso the felony action squad ain’t sh_t.” He signed the note “Mata’.” The 900-page police report later concludes with the following statement concerning Essex’s motive: “What he intended to achieve will probably remain in the grave with him.” The New York office of the Black Panther Party will send a note of condolence to Essex’s parents, calling Essex a “warrior and revolutionary.” The New Orleans Times-Picayune will state that Essex harbored “an insane hatred of the police.” (New Orleans Times-Picayune 12/16/2011; Hustmyre 2012)
Former Florida state legislator Benhardt “Ben” Klassen, who served as Florida chair of the 1968 presidential campaign of George Wallace (D-AL), forms the Church of the Creator (COTC) in Lighthouse Point, Florida. Klassen was born in the Ukraine in 1918, and later lived in Mexico and Canada before moving to California as an adult. He is a former elementary school teacher and an inventor, earning a patent for an electric can opener in 1954. He moved to Florida in 1958, where he became a successful real estate agent. He became a Republican representative to the Florida House of Representatives in 1965, where he campaigned against desegregation and the federal government. He is a lifetime member of the far-right John Birch Society (see March 10, 1961 and December 2011), though he has denounced the group as a “smokescreen for the Jews” and accused Wallace of “betraying” his supporters by intentionally courting African-American support. Klassen explains his race-based religion in his church’s 511-page holy book, Nature’s Eternal Religion. Among its “16 commandments”: “It is our sacred goal to populate the lands of this earth with White people exclusively.” Klassen popularizes the war cry “Rahowa,” which stands for RAcial HOly WAr. (Anti-Defamation League 1993; Southern Poverty Law Center 9/1999) Members of the COTC, according to Klassen’s writings, see “every issue, whether religious, political, or racial, [a]s viewed through the eyes of the White Man and exclusively from the point of view of the White race as a whole.… We completely reject the Judeo-democratic-Marxist values of today and supplant them with new and basic values, of which race is the foundation.” While most right-wing extremist groups use Christianity to justify their racism, Klassen and the COTC attack Christianity as a “tremendous weapon in the worldwide Jewish drive of race-mixing.” Klassen writes that Jews “concocted” Christianity “for the very purpose of mongrelizing and destroying the White Race.” According to Klassen, Jews are “parasites” who “control and manipulate the finances, the propaganda, the media, and the governments of the world.” (Anti-Defamation League 7/6/1999) In 2004, author Chip Berlet will write that Klassen’s religion, “Creativity,” claims that whites are destined “to rule the world and thus fulfill the purpose of the universe. To attain this destiny, it is necessary to destroy the enemies and race traitors who prevent this from happening. The primary enemies are Jews, blacks, and other ‘mud people,’ and white race traitors, including most Christians. Klassen credits the influence of Hitler’s Mein Kampf in the development of his views.… What Klassen did was to pick up ideas from the theories of [German philosopher Friedrich] Nietzsche, pantheisim, Odinism, and Celtic paganism as filtered through German Nazi retelling of the Norse heroic warrior myths, to create a religion of Aryanist white supremacy. Discarding the details, he created a form of cosmotheism in which the supreme power is the collective will of the Aryan race. The duty of every member of the Aryan race is to reflect the ideals of the heroic warrior and do battle with the enemies of the race.… Like other forms of fascism, the idea of action is central to the philosophy, as is the celebration of violence and the spilling of blood as part of a rite of passage to full adulthood.” (Chip Berlet 2004)
A wave of politically motivated murders takes place in San Francisco, claiming the lives of 15 people. Eight others are wounded. Most of the victims are shot to death; the first two victims, Richard Hague and his wife Quita, are attacked with machete blows. Quita Hague is also sexually molested. She is nearly decapitated, but Hague, though suffering terrible wounds, survives. Shopkeeper Saleem “Sammy” Erakat, a Jordanian Arab, is murdered, apparently for appearing “too white.” College student Angela Roselli, who survives an attack, remembers her assailant as having “this zombie look” as he shot her. “It was like he was in a trance. He was looking at me, but he was looking through me,” she says. The killings, called the “Zebra murders,” are later found to be racially motivated. “It was a very frightening time for the people of this city because of the random nature of the shootings,” future San Francisco Mayor Art Agnos will recall; Agnos is gravely wounded by one of the killers in December 1973, shot twice in the back. The killings are perpetrated by a small number of black extremists, members of the “Death Angels,” a splinter group from the Nation of Islam, which officially repudiates violence in its name. Mayor Joseph Alioto tells reporters that the “Death Angels” are a group “dedicated to the murder and mutilation of whites and dissident blacks.” Local press accounts falsely report that the killings are “initiation rituals” for membership in the Nation of Islam, and local African-American leaders take umbrage at Alioto’s implication that members of that organization are responsible for the murders. The name “Zebra” does not come from the black-against-white nature of the murders, but from the special radio band, “Z for Zebra,” used by police during their seven-month hunt for the killers. During the intensive police investigation, Alioto orders sweeping stop-and-search patrols that target many black males over six feet tall. After some 600 black men are detained, US District Judge Alphonso Zirpoli rules the dragnet is unconstitutional, calling it racial “profiling.” Agnos will recall: “The whole city was just in the grip of terror. But it was an ugly thing, a time when we failed our test on our commitment to civil liberties. When we are fearful, we tend to compromise that commitment too quickly.” Robert Brooks, a security guard detained and questioned by police, tells a reporter: “I think the mayor is persecuting the black community for the acts of a few crazy dudes. If the killings continue, some other people are talking about retaliation against blacks. That will be too bad. The thing is bad enough now.” Anthony Cornelius Harris, an accomplice in the murders, eventually gives information that leads to the arrest and conviction of four men: Manuel Moore, J.C. Simon, Larry C. Green, and Jessie Lee Cooks. All of the four are later convicted of 74 counts of murder, conspiracy, and assault. Moore, Simon, and Green will insist they are innocent of the charges; Cooks has already pled guilty to the murder of one of the victims, physical therapist Frances Rose. Another participant, Leroy Decker, who attempted to kill a gas company clerk, Robert Stoeckmann, is later convicted of assault with a deadly weapon. Five others are arrested and charged with participation in the murders, but are later released for lack of evidence. (Salter 10/13/2002; TruTV 2010)
The Supreme Court alters voting rights in the case of Beer v. United States. The Court rules that Section 5 of the Voting Rights Act (VRA—see August 6, 1965, 1970, and 1975) allows for “preclearance” of election changes that are unfair to minorities as long as the changes are not “retrogressive,” or make conditions worse than they already are. Secretary of Agriculture Earl Butz resigns after making a stridently racist joke that is reported in Rolling Stone. Butz, flying from New Mexico to California, found himself on board with singers Pat Boone and Sonny Bono as well as former Nixon White House counsel John Dean, now working as a reporter for Rolling Stone. Butz, whom Time magazine describes as a “gregarious man” with a “barnyard sense of humor,” wanders over to kibitz with Boone and Bono, both active in the Republican Party. When Boone asks why the Republicans aren’t able to attract more black voters, Butz responds: “I’ll tell you what the coloreds want. It’s three things. First, a tight p_ssy; second, loose shoes; and third, a warm place to sh_t.” Dean later reports the joke in his Rolling Stone column, without naming Butz as its source. (Interestingly, a Japanese newspaper sanitized the translation, reporting Butz as saying, “Blacks wanted only three things in life: pleasant family relations, comfortable footwear, and adequate toilet facilities.”) Before long, other media outlets have learned who said it, and Butz was revealed in the media as the perpetrator of the joke.
Ford Initially Defends Butz - President Ford does not immediately fire Butz because the secretary claims that his words were taken out of context; he claims that the joke was preceded with, “Things have come a long way since the days when a ward politician could say…” Ford considers Butz a friend and is reluctant to fire him outright; furthermore, Ford doesn’t want to alienate voters in key farm states. But when both Democrats and Republicans begin calling for Butz’s firing, Butz decides to resign. Butz tells reporters that he is not a racist, and that his resignation “is the price I pay for a gross indiscretion in a private conversation.” Time magazine later reports that Ford’s indecision costs him credibility and support—instead of doing the right thing when the time came, Ford seemed instead to merely cave under pressure. A top Ford aide later says, “I’m afraid some people will start wondering how straight a guy, how nice a fellow the president really is.” Ford loses little support in the farm states; although organizations like the American Farm Bureau Federation bemoan Butz’s resignation, smaller farmers rejoice in his departure, saying that he favored big producers and agribusiness interests over smaller, independent farmers. As for Butz himself, he is remarkably unrepentant and oblivious to the racial content of his humor. He will tell a reporter in the days to follow: “You know, I don’t know how many times I told that joke, and everywhere—political groups, church groups—nobody took offense, and nobody should. I like humor. I’m human.” (Time 10/18/1976; Reston 2007, pp. 54)
Casual Racism Mark of Butz's Breed of Politician - In February 2008, in a column marking Butz’s passing, Slate’s Timothy Noah will write that Butz was one of the last of a breed of politicians who routinely peppered their conversations with off-color, racist, and offensive remarks, certain that their power and position made them untouchable. Butz was certainly not the only one in the Nixon and Ford administration to make racist remarks: in 1971, President Nixon himself told Donald Rumsfeld, that blacks “basically are just out of the trees. Now let’s face it, they are.” (Nixon was wise enough not to make such remarks in public.) But by 1976, most lawmakers and office holders had learned to keep such observations to themselves. Noah will write: “Butz was not one of the smarter ones. He was a bigot and, even then, at 66, not a young man. And so he got caught in a paradigm shift. Before Butz, there remained a snickering tolerance among the powerful for jokes denigrating the humanity of blacks, Jews, and homosexuals. After Butz—well, the jokes about gays limped along for awhile, but it finally sank in that racism and anti-Semitism would seldom be tolerated, even in private.” (Noah 2/4/2008)
White supremacist and separatist William Pierce, a leader of the neo-Nazi National Alliance (see 1970-1974), publishes a novel called The Turner Diaries under the pseudonym “Andrew Macdonald.”
Former College Professor - Pierce has a doctorate in physics from the University of Colorado, and taught at Oregon State University for three years before joining the American Nazi Party, taking over leadership of the group after its head, George Lincoln Rockwell, was assassinated. In 1970, Pierce and others left that organization and joined the National Youth Alliance, later renamed the National Alliance. He will later say that the violence and disruption of the civil rights movement prompted his decision to join Nazi and white supremacist organizations. “I became concerned with the general abandonment of standards and long-accepted values,” he will write. “The standards of excellence that had prevailed at most universities were becoming abandoned ideas that were in the way of social progress for people of color. The old-fogey standards had to go, and now we had to judge students and professors by the new standards of social relevance and performance. That concerned me a lot.”
Genocidal 'Future History' - The novel is a “future history” of the US after the nation, and eventually the world, is “purged” of “inferior” races via an Aryan revolution that overthrows the US government and puts white “Aryans” in charge. Pierce actually began the book as a series of installments for the racist tabloid “Attack!” a publication of the National Youth Alliance. The Anti-Defamation League will term the book “[l]urid, violent, apocalyptic, misogynistic, racist, and anti-Semitic.” The book is privately printed through the National Alliance’s National Vanguard Press, but in 1998, independent publisher Barricade Books will begin publishing it as well. From 1975 through 1978, Pierce serialized the novel in the Alliance’s newsletter, “Attack!” (later renamed “National Vanguard”). In March 1997, he will explain his rationale for writing the novel, saying: “In 1975, when I began writing The Turner Diaries… I wanted to take all of the feminist agitators and propagandists and all of the race-mixing fanatics and all of the media bosses and all of the bureaucrats and politicians who were collaborating with them, and I wanted to put them up against a wall, in batches of a thousand or so at a time, and machine-gun them. And I still want to do that. I am convinced that one day we will have to do that before we can get our civilization back on track, and I look forward to the day.”
Fictional Story Inspires Oklahoma City Bombing - The story hinges on the experiences and “recollections” of Earl Turner, an Aryan separatist who chronicles the extermination of minorities, Jews, and other “undesirables” via an armed insurrection. The book will become highly influential in far-right circles. One of the most notable scenes in it is that of Turner’s guerrilla unit detonating a homemade “fertilizer bomb” at FBI headquarters, killing hundreds; the ADL will note it as “a passage that came to be seen as foreshadowing, and as an inspiration to, Oklahoma City bomber Timothy McVeigh” (see 8:35 a.m. - 9:02 a.m. April 19, 1995). The white supremacist guerrilla army of the book is called “The Organization”; its vocabulary and methodologies will be adopted to one extend or another by a number of white supremacist and separatist organizations. The novel begins by stating: “If the White nations of the world had not allowed themselves to become subject to the Jew, to Jewish ideas, to the Jewish spirit, this war would not be necessary. We can hardly consider ourselves blameless. We can hardly say we had no choice, no chance to avoid the Jew’s snare. We can hardly say we were not warned.… The people had finally had their fill of the Jews and their tricks.… If the Organization survives this contest, no Jew will—anywhere. We’ll go to the Uttermost ends of the earth to hunt down the last of Satan’s spawn.” The revolution of the “Organization” is triggered by the passage of the “Cohen Act,” legislation which effectively bans Americans from owning weapons. Pierce writes that the forcible disarming of the citizenry results in anarchy: “Robberies of this sort had become all too common since the Cohen Act, with groups of Blacks forcing their way into White homes to rob and rape, knowing that even if their victims had guns they would probably not dare use them.” The book depicts scenes of violence in gory, graphic detail (including torture and racially-motivated lynchings), and gives detailed explanations of how the characters construct a variety of explosive devices. The book gives the rationale for its fictional murder of hundreds at the FBI building: “It is a heavy burden of responsibility for us to bear, since most of the victims of our bomb were only pawns who were no more committed to the sick philosophy or the racially destructive goals of the System than we are. But there is no way we can destroy the System without hurting many thousands of innocent people.… And if we don’t destroy the System before it destroys us… our whole race will die.” In the novel, Turner dies during a successful suicide mission, when he detonates a nuclear weapon over the Pentagon. White domination of the planet is ultimately achieved by the massive deployment of nuclear weapons. Organizations such as The Order (which will carry out the murder of progressive talk show host Alan Berg—see June 18, 1984 and After), The New Order, and the Aryan Republican Army (see 1992 - 1995) will cite the novel as inspiration for their efforts. Inspiration for Texas Murder - In Texas in 1998, when African-American James Byrd Jr. is beaten and dragged to his death behind a pickup truck (see June 7, 1998 and After), one of his assailants, John King, will say, “We’re starting The Turner Diaries early.”
Sparks Many Imitators - The novel will spark a number of imitations, including 2003’s Angle Iron, about a right-wing attack on the US power grid; 2001’s Dark Millennium, depicting a white supremacist president presiding over the extermination of African-Americans; 2004’s Deep Blue, which transports the racial themes into a science-fictional presentation; 2001’s Hold Back This Day, in which whites establish an Aryan colony on Mars; 1999’s One in a Million, in which a white separatist declares war on the IRS; 2001’s The Outsider, whose white hero goes on a murderous spree among African-Americans; and 1991’s Serpent’s Walk, in which a resurgent Nazi underground claims the planet for its own. Wide Influence - Both Pierce and his novel will become highly influential in white supremacist and anti-government circles. Jerry Dale, a West Virginia sheriff who monitors Pierce for years, says: “He’s become a spiritual leader. He’s not a nut. Looking at him and talking to him, you don’t get a feeling he’s crazy. He’s not violent. But the way he incites people, to me, that is frightening.” Pierce will go on to write a number of books (including comic books) and periodicals, and host a radio show that will be broadcast in a dozen states. However, he always publicly states that he does not advocate actual violence. (Janofsky 7/5/1995)
Second Novel - Ten years later, Pierce will publish a second novel, Hunter, which depicts a lone assassin targeting Jews and African-Americans. Both this book and a reprint of The Turner Diaries will be released by a publishing house affiliated with the National Alliance, the National Vanguard Press (see 1988).
William Pierce, the founder of the neo-Nazi National Alliance (see 1970-1974) and the author of the inflammatory and highly influential white supremacist novel The Turner Diaries (see 1978), begins holding weekly meetings of the Cosmotheist Community Church (CCC), a religion of his own creation that promotes white supremacy. Pierce, who was turned down by the IRS in his 1977 attempts to persuade it to classify the Alliance as a tax-exempt “educational” organization, will succeed in getting the IRS to classify the CCC as a religious tax-exempt organization in 1983, though that status will be largely revoked in 1986. James Wickstrom (see 1975 - 1978), a self-styled “minister” of the racist, anti-Semitic Christian Identity ideology (see 1960s and After) and a member of the anti-government Posse Comitatus (see 1969), moves back to his childhood state of Wisconsin from his home in Missouri, at the invitation of Donald Minniecheske, who owns 570 acres of land on the shores of the Embarrass River and wants to create a “township” for the Posse that would be run without recognition of federal, state, or local law. Minniecheske wants Wickstrom to be part of the new “township” and what Minniecheske calls the “rejuvenation” of the Posse. He begins by naming himself “national director of counter insurgency” of the organization. After building a bar and moving a few trailers onto the land, Wickstrom and Minniecheske name the property the Constitutional Township of Tigerton Dells. Wickstrom names himself the township’s judge and municipal clerk, and grants Minniecheske a new liquor license (he had lost his previous license two years before). Wickstrom also begins traveling through the Midwestern farm belt, appearing at meeting halls, in basements, and at farm shows. “I knew that something had to be done. I knew that the ranchers and the farmers were being meticulously destroyed by the Jew banking system in America,” Wickstrom will later say. Wickstrom preaches the gospel of anti-tax protest and refusal to pay income taxes (see 1951-1967). He tells his listeners that since taxation and the federal government are both illegitimate, and since they are “sovereign citizens” of the US, they can pay their tax debts with fictitious money orders. Driver’s licenses and ZIP codes are equally illegitimate, Wickstrom says, and tells his listeners they are the victims of a widespread Jewish conspiracy that works through tax collectors, law enforcement officials, judges, and the like to oppress them. Jews and tax collectors should be lynched, Wickstrom advises. Dairy farmer Floyd Cochran will later recall listening to Wickstrom, saying: “In the ‘70s and ‘80s farming went through a drastic change. A lot of people I’d known a good part of my life went out of business. Wickstrom was organizing farmers out West, appearing at farm shows and things of that nature, telling farmers you are losing your place not because of something you did but because the Jews want to take away your farms.” By 1980, Tigerton Dells becomes the center of Posse-led paramilitary training; Wickstrom will later claim that Posse seminars draw thousands of participants who are taught survival skills and covert military operations by high-ranking Vietnam veterans. That same year, Wickstrom runs for the US Senate on the far-right Constitution Party ticket. In 1982, a local radio station begins broadcasting his speeches, and he runs for governor of Wisconsin. He continues preaching, and tells his listeners, falsely, that “his” Posse has over two million members. When North Dakota Posse member Gordon Kahl kills two US Marshals and flees (see February 13, 1983 and After), Wickstrom uses the incident to vault to national prominence and establish himself as a Posse leader (see February 14-21, 1983), moderating his usual virulently racist rhetoric, emphasizing his patriotism and strong Christian beliefs, and presenting himself as a champion of ordinary farmers and working people. A number of newsletters released by Representative Ron Paul (R-TX), a self-described libertarian and strict Constitutionalist, contain what many believe to be racially objectionable remarks and claims. Paul’s monthly newsletters are published under a variety of names, including “Ron Paul’s Freedom Report,” “Ron Paul Political Report,” and “The Ron Paul Survival Report.” The newsletters are published by several organizations, including Paul’s non-profit group the Foundation for Rational Economics and Education, and a group called Ron Paul & Associates. For a time, Ron Paul & Associates also publishes “The Ron Paul Investment Letter.” In 1996, a challenger for Paul’s House seat, Charles “Lefty” Morris (D-TX) makes public some of the racially inflammatory content in Paul’s newsletters. The newsletters will be publicly exposed in a 2008 article in the New Republic (see January 8-15, 2008). The content, culled from years of newsletters, includes such claims and observations as:
From a 1992 newsletter: “[O]pinion polls consistently show only about 5 percent of blacks have sensible political opinions, i.e. support the free market, individual liberty, and the end of welfare and affirmative action.” Politically “sensible” blacks are outnumbered “as decent people.” The same report claims that 85 percent of all black men in the District of Columbia have been arrested, and continues: “Given the inefficiencies of what DC laughingly calls the ‘criminal justice system,’ I think we can safely assume that 95 percent of the black males in that city are semi-criminal or entirely criminal.… [W]e are constantly told that it is evil to be afraid of black men, [but] it is hardly irrational. Black men commit murders, rapes, robberies, muggings, and burglaries all out of proportion to their numbers.”
The same 1992 edition has Paul claiming that the government should lower the age at which accused juvenile criminals can be prosecuted as adults. “We don’t think a child of 13 should be held responsible as a man of 23,” the newsletter states. “That’s true for most people, but black males age 13 who have been raised on the streets and who have joined criminal gangs are as big, strong, tough, scary, and culpable as any adult and should be treated as such.” The newsletter also asserts that sophisticated crimes such as “complex embezzling” are conducted exclusively by non-blacks: “What else do we need to know about the political establishment than that it refuses to discuss the crimes that terrify Americans on grounds that doing so is racist? Why isn’t that true of complex embezzling, which is 100 percent white and Asian?”
Another 1992 newsletter states, “[I]f you have ever been robbed by a black teen-aged male, you know how unbelievably fleet-footed they can be.”
An undated newsletter excerpt states that US Representative Barbara Jordan (D-TX), who is African-American, is “the archetypical half-educated victimologist” whose “race and sex protect her from criticism.”
The newsletters often use disparaging nicknames and descriptions for lawmakers. Jordan is called “Barbara Morondon.” Congressional Delegate Eleanor Holmes Norton is a “black pinko.” Donna Shalala, the head of the Department of Health and Human Services during the Clinton administration, is a “short lesbian.” Ron Brown, the head of the Department of Commerce during the Clinton administration, is a “racial victimologist.” Roberta Achtenberg, the first openly gay public official confirmed by the US Senate, is a “far-left, normal-hating lesbian activist.”
Newsletter items through the early 1990s attack Dr. Martin Luther King Jr., renaming him “X-Rated Martin Luther King” and labeling him a “world-class philanderer who beat up his paramours,” “seduced underage girls and boys,” and “made a pass at” fellow civil rights leader Ralph Abernathy. One newsletter ridicules black activists who wanted to rename New York City after King, suggesting that “Welfaria,” “Zooville,” “Rapetown,” “Dirtburg,” and “Lazyopolis” were better alternatives. The same year, King is described as “a comsymp [Communist sympathizer], if not an actual party member, and the man who replaced the evil of forced segregation with the evil of forced integration.” One 1990 excerpt says of the King holiday: “I voted against this outrage time and again as a congressman. What an infamy that Ronald Reagan approved it! We can thank him for our annual Hate Whitey Day!”
An undated excerpt from a newsletter entry titled “Needlin’” says: “‘Needlin’,’ a new form of racial terrorism, has struck New York City streets on the tony Upper West Side. At least 39 white women have been stuck with used hypodermic needles—perhaps infected with AIDS—by gangs of black girls between the ages of 12 and 14. The New York Times didn’t find this fit to print for weeks and weeks, until its candidate David Dinkins [New York City’s first African-American mayor] was safely elected. Even then the story was very low key, with race mentioned many paragraphs into it. Who can doubt that if this situation were reversed, if white girls had done this to black women, we would have been subjected to months-long nationwide propaganda campaign on the evils of white America? The double standard strikes again.” The excerpt is presumably published sometime after 1989, when Dinkins is elected mayor of New York City. In 2011, NewsOne reporter Casey Gane-McCalla will write, “I could find no evidence of this ‘epidemic’ and the article seems to have no point other than to make white people scared of black people.”
A December 1989 “special issue” of the Investment Letter addresses what it calls “racial terrorism,” and tells readers what to expect from the 1990s: “Racial Violence Will Fill Our Cities” because “mostly black welfare recipients will feel justified in stealing from mostly white ‘haves.’” In February 1990, another newsletter warns of “The Coming Race War.” In November 1990, an item advises readers: “If you live in a major city, and can leave, do so. If not, but you can have a rural retreat, for investment and refuge, buy it.” In June 1991, an entry on racial disturbances in Washington, DC’s Adams Morgan neighborhood is titled, “Animals Take Over the DC Zoo,” calling the disturbances “the first skirmish in the race war of the 1990s.”
In June 1992, the Ron Paul Political Report publishes a “special issue” that explains the Los Angeles riots, claiming, “Order was only restored in LA when it came time for the blacks to pick up their welfare checks three days after rioting began.” The looting, the newsletter writes, is a natural byproduct of government indulging the black community with “‘civil rights,’ quotas, mandated hiring preferences, set-asides for government contracts, gerrymandered voting districts, black bureaucracies, black mayors, black curricula in schools, black TV shows, black TV anchors, hate crime laws, and public humiliation for anyone who dares question the black agenda.” It also denounces “the media” for believing that “America’s number one need is an unlimited white checking account for underclass blacks.” The newsletter praises Asian merchants in Los Angeles for having the fortitude to resist political correctness and fight back. Koreans, the newsletter writes, are “the only people to act like real Americans” during the riots, “mainly because they have not yet been assimilated into our rotten liberal culture, which admonishes whites faced by raging blacks to lie back and think of England.” Another newsletter entry from around the same time strikes some of the same chords in writing about riots in Chicago after the NBA’s Chicago Bulls win the championship: “[B]lacks poured into the streets in celebration. How to celebrate? How else? They broke the windows of stores to loot, even breaking through protective steel shutters with crowbars to steal everything in sight.” The entry goes on to claim that black rioters burned down buildings all along Chicago’s “Magnificent Mile,” destroyed two taxicabs, “shot or otherwise injured 95 police officers,” killed five people including a liquor-store owner, and injured over 100 others. “Police arrested more than 1,000 blacks,” the newsletter claims. In 2011, Gane-McCalla will write that the newsletter entry falsely accuses blacks of perpetuating all of the violence, when in reality, the violence was perpetuated by people of all ethnicities. One thousand people—not 1,000 blacks—were arrested. And, he will write, “two officers suffered minor gunshot wounds and that 95 were injured in total, but the way Paul phrased it, it would seem most of the 95 officers injured were shot.”
An undated newsletter entry says that “black talk radio” features “racial hatred [that] makes a KKK rally look tame. The blacks talk about their own racial superiority, how the whites have a conspiracy to wipe them out, and how they are going to take over the country and wipe them out. They only differ over whether they should use King’s non-violent approach (i.e. state violence) or use private violence.”
An undated newsletter entry discusses “the newest threat to your life and limb, and your family—carjacking,” blaming it on blacks who follow “the hip-hop thing to do among the urban youth who play unsuspecting whites like pianos.” The entry advises potential carjacking victims to shoot carjackers, then “leave the scene immediately [and] dispos[e] of the wiped-off gun as soon as possible.” The entry concludes: “I frankly don’t know what to make of such advice, but even in my little town of Lake Jackson, Texas, I’ve urged everyone in my family to know how to use a gun in self-defense. For the animals are coming.” (Bernstein 5/21/1996; Kirchick 1/8/2008; Gane-McCalla 5/6/2011)
According to author and militia/white supremacist expert David Neiwert, much of Paul’s information about black crime comes from Jared Taylor, the leader of the American Renaissance movement (see January 23, 2005). Taylor, Neiwert will write, cloaks his racism in “pseudo-academic” terminology that is published both in a magazine, American Renaissance, and later in a book, The Color of Crime, both of which make what Neiwert calls “unsupportable claims about blacks.” (David Neiwert 6/8/2007)
Conspiracies, Right-Wing Militias, and Bigotry - The newsletters often contain speculations and assertions regarding a number of what reporter James Kirchick will call “shopworn conspiracies.” Paul, as reflected in his newsletter, distrusts the “industrial-banking-political elite” and does not recognize the federally regulated monetary system and its use of paper currency. The newsletters often refer to to the Bilderberg Group, the Trilateral Commission, and the Council on Foreign Relations. In 1978, a newsletter blames David Rockefeller, the Trilateral Commission, and “fascist-oriented, international banking and business interests” for the Panama Canal Treaty, which it calls “one of the saddest events in the history of the United States.” A 1988 newsletter cites a doctor who believes that AIDS was created in a World Health Organization laboratory in Fort Detrick, Maryland. In addition, Ron Paul & Associates sells a video about the Branch Davidian tragedy outside Waco (see April 19, 1993) produced by “patriotic Indiana lawyer Linda Thompson” (see April 3, 1993 and September 19, 1994), as a newsletter calls her, who insists that Waco was a conspiracy to kill ATF agents who had previously worked for President Clinton as bodyguards. Kirchick will note that outside of the newsletters, Paul is a frequent guest on radio shows hosted by Alex Jones, whom Kirchick will call “perhaps the most famous conspiracy theorist in America.”
Connections to Neo-Confederate Institute - Kirchick goes on to note Paul’s deep ties with the Ludwig von Mises Institute, a libertarian think tank in Alabama founded by Paul’s former chief of staff, Lew Rockwell; Paul has taught seminars at the institute, serves as a “distinguished counselor,” and has published books through the institute. The von Mises Institute has a long history of support for white-supremacist neo-Confederate groups, including the League of the South, led by Confederate apologist Thomas Woods (see October 14, 2010). Paul will endorse books by Woods and other neo-Confederates. Paul seems to agree with members of the von Mises institute in their view that the Civil War was the beginning of a horrific federal tyranny that ran roughshod over states’ rights. Paul, in his newsletters and speeches, has frequently espoused the idea of states’ secession as protest against the federal government.
Lamenting the South African Revolution - In March 1994, a newsletter warns of a “South African Holocaust,” presumably against white South Africans, once President Nelson Mandela takes office. Previous newsletters call the transition from a whites-only government to a majority-African government a “destruction of civilization” that is “the most tragic [to] ever occur on that continent, at least below the Sahara.”
Praise for Ku Klux Klan Leader's Political Aspirations - In 1990, a newsletter item praises Louisiana’s David Duke, the former Imperial Wizard of the Ku Klux Klan, for coming in a strong second in that state’s Republican Senate primary. “Duke lost the election,” the newsletter says, “but he scared the blazes out of the Establishment.” In 1991, a newsletter asks, “Is David Duke’s new prominence, despite his losing the gubernatorial election, good for anti-big government forces?” The conclusion is that “our priority should be to take the anti-government, anti-tax, anti-crime, anti-welfare loafers, anti-race privilege, anti-foreign meddling message of Duke, and enclose it in a more consistent package of freedom.” Duke will in return give support to Paul’s 2008 presidential candidacy.
Attacking Gays, AIDS Research - Paul’s newsletters often praise Paul’s “old colleague,” Representative William Dannemeyer (R-CA), a noted anti-gay activist who often advocates forcibly quarantining people suffering from AIDS. Paul’s newsletters praise Dannemeyer for “speak[ing] out fearlessly despite the organized power of the gay lobby.” In 1990, one newsletter mentions a reporter from a gay magazine “who certainly had an axe to grind, and that’s not easy with a limp wrist.” In an item titled, “The Pink House?” the newsletter complains about President George H.W. Bush’s decision to sign a hate crimes bill and invite “the heads of homosexual lobbying groups to the White House for the ceremony,” adding, “I miss the closet.” The same article states, “Homosexuals, not to speak of the rest of society, were far better off when social pressure forced them to hide their activities.” If homosexuals are ever allowed to openly serve in the military, another newsletter item concludes, they, “if admitted, should be put in a special category and not allowed in close physical contact with heterosexuals.” One newsletter calls AIDS “a politically protected disease thanks to payola and the influence of the homosexual lobby,” and alternates between praising anti-gay rhetoric and accusing gays of using the disease to further their own political agenda. One item tells readers not to get blood transfusions because gays are trying to “poison the blood supply.” Another cites a far-right Christian publication that advocates not allowing “the AIDS patient” to eat in restaurants, and echoes the false claim that “AIDS can be transmitted by saliva.” The newsletters often advertise a book, Surviving the AIDS Plague, which makes a number of false claims about casual transmission and defends “parents who worry about sending their healthy kids to school with AIDS victims.”
Blasting Israel - Kirchick will note that the newsletters are relentless in their attacks on Israel. A 1987 issue of the Investment Letter calls Israel “an aggressive, national socialist state.” A 1990 newsletter cites the “tens of thousands of well-placed friends of Israel in all countries who are willing to wok [sic] for the Mossad in their area of expertise.” Of the 1993 World Trade Center bombing (see February 26, 1993), a newsletter said, “Whether it was a setup by the Israeli Mossad, as a Jewish friend of mine suspects, or was truly a retaliation by the Islamic fundamentalists, matters little.” Another newsletter column criticizing lobbyists says, “By far the most powerful lobby in Washington of the bad sort is the Israeli government” and that the goal of the “Zionist movement” is to stifle criticism.
Violent Anti-Government Rhetoric - In January 1995, three months before the Oklahoma City bombing (see 8:35 a.m. - 9:02 a.m. April 19, 1995), a newsletter lists “Ten Militia Commandments,” describing “the 1,500 local militias now training to defend liberty” as “one of the most encouraging developments in America.” It warns militia members that they are “possibly under BATF [Bureau of Alcohol, Tobacco and Firearms] or other totalitarian federal surveillance” and prints bits of advice from the Sons of Liberty, an anti-government militia based in Alabama—among them, “You can’t kill a Hydra by cutting off its head,” “Keep the group size down,” “Keep quiet and you’re harder to find,” “Leave no clues,” “Avoid the phone as much as possible,” and “Don’t fire unless fired upon, but if they mean to have a war, let it begin here.”
Slandering Clinton - Newsletters printed during President Clinton’s terms in office claim that Clinton uses cocaine and has fathered illegitimate children. Repeating the rumor that Clinton is a longtime cocaine user, in 1994 Paul writes that the speculation “would explain certain mysteries” about the president’s scratchy voice and insomnia. “None of this is conclusive, of course, but it sure is interesting,” he states.
Distance from Newsletter - In 2008, Paul campaign spokesman Jesse Benton will attempt to distance Paul from the newsletters, saying that while Paul wrote some of their content, he often did not, and in many instances never saw the content. Benton will say that the frequent insults and vitriol directed at King are particularly surprising, because, Benton will say, “Ron thinks Martin Luther King is a hero.” In 1996, Paul claims ownership of the content, but says that Morris took the newsletter quotes “out of context” (see May 22 - October 11, 1996). In 2001, Paul will claim that he did not write any of the passages, and will claim having no knowledge of them whatsoever (see October 1, 2001). Most of the newsletters’ articles and columns contain no byline, and the Internet archives of the newsletters begin in 1999. In 2008, Kirchick will find many of the older newsletters on file at the University of Kansas and the Wisconsin Historical Society. Kirchick will note the lack of bylines, and the general use of the first person in the material, “implying that Paul was the author.” Kirchick will conclude: “[W]hoever actually wrote them, the newsletters I saw all had one thing in common: They were published under a banner containing Paul’s name, and the articles (except for one special edition of a newsletter that contained the byline of another writer) seem designed to create the impression that they were written by him—and reflected his views. What they reveal are decades worth of obsession with conspiracies, sympathy for the right-wing militia movement, and deeply held bigotry against blacks, Jews, and gays.” Paul, Kirchick writes, is “a member in good standing of some of the oldest and ugliest traditions in American politics.” Kirchick will conclude: “Paul’s campaign wants to depict its candidate as a naive, absentee overseer, with minimal knowledge of what his underlings were doing on his behalf. This portrayal might be more believable if extremist views had cropped up in the newsletters only sporadically—or if the newsletters had just been published for a short time. But it is difficult to imagine how Paul could allow material consistently saturated in racism, homophobia, anti-Semitism, and conspiracy-mongering to be printed under his name for so long if he did not share these views. In that respect, whether or not Paul personally wrote the most offensive passages is almost beside the point. If he disagreed with what was being written under his name, you would think that at some point—over the course of decades—he would have done something about it.” (Kirchick 1/8/2008; Gane-McCalla 5/6/2011) In 2008, Paul will deny writing virtually any of his newsletters’ various content (see January 8-15, 2008 and January 16, 2008).
The First General Convention of the neo-Nazi National Alliance (see 1970-1974) is held in Arlington, Virginia. The speakers for the event are Alliance leader William Pierce, Ted O’Keefe, and Mark Weber. O’Keefe and Weber will go on to head the Institute for Historical Review, an Alliance-funded think tank that specializes in denying the Holocaust. (Center for New Community 8/2002 )
The Dartmouth Review, an alternative campus newspaper with a conservative slant, is founded by Greg Fossedal, the former editor of Dartmouth College’s official student newspaper, The Dartmouth. Fossedal feels that the Dartmouth administration is composed of “Stalinists” who oppose his views. Taking several staffers with him, Fossedal leaves The Dartmouth and founds the Dartmouth Review. The newspaper, which receives no university funding, quickly demands that the university purge most non-Western curriculum materials and coursework, takes a strong stance against affirmative action (claiming that the “administration has given in to every minority demand”), complains that professors are unfairly punishing students who express pro-American and pro-Christian viewpoints, and demands a return to “traditional values.” Early issues feature an article calling for the return of the old Dartmouth Indian symbol, and calling modern Native Americans “drunken, ignorant, and culturally lost”; an interview with a former Ku Klux Klan leader, illustrated with a staged photo of a black person lynched from a tree; and an open letter on parents’ weekend that says affirmative action at Dartmouth “explains your son’s stupid friends.” Before long, the Review begins receiving funding from conservative organizations and individuals, beginning with conservative alumni, and eventually receives funding from around the country as part of a program by the right-wing Institute for Educational Affairs to develop conservative publications on college campuses. Early support comes from former Reagan White House staffer Morton Blackwell, whose Leadership Institute will later recruit Review editors to train campus conservatives starting up their own newspapers (including Ann Coulter, who will start a similar publication, the Cornell Review, at Cornell University.) According to a 2006 article by the Dartmouth Free Press, “[t]he Dartmouth Review probably could not have survived without the national publicity it received by claiming Dartmouth was trying to silence its conservative voice.” The Review quickly gains a reputation for racism (see March 15, 1982, 1983, and August 2002), anti-Semitism (see October 1982, November 9-10, 1988, and October 4, 1990), homophobia (see 1981, 1984, and 1985), and personal innuendos, such as when it calls one visiting pro-choice speaker “allegedly syphilitic.” Relations between the Review and campus administrators sour even further as time goes on. The US Supreme Court guts a significant portion of the Voting Rights Act (VRA—see August 6, 1965, 1970, and 1975) by ruling that voters must prove racially discriminatory intent in order to prevail in litigation under the VRA. In the case of City of Mobile v. Bolden, the Court rules 6-3 that the previous standard of proving discriminatory results is no longer adequate. Disenfranchised voters must now prove intent, a far higher standard, before receiving redress. The case originates in Mobile, Alabama’s practice of electing city commissioners under an at-large voting scheme. No African-American had ever been elected to the commission, and a number of Mobile citizens challenged the constitutionality of the at-large scheme. The Court found that at-large schemes such as that employed by the city of Mobile only violate the Constitution if they deliberately serve to minimize or cancel out the voting potential of minorities. Justice Potter Stewart, writing for the plurality, finds that the right to equal participation in the electoral process is aimed not for the protection of any political group. Moreover, he writes that the evidence fails to show that Mobile operates a voting system with the intent to discriminate. The conservative justices largely side with Stewart. The liberals are split. Justices Harry Blackmun and John Paul Stevens concur with Stewart’s ruling for different reasons than those expressed by Stewart. Justices William Brennan, Thurgood Marshall, and Byron White dissent, with Brennan and White arguing that the burden of proof had been met, and Marshall arguing that the burden of proof should be on Mobile to show that it refused to modify its voting scheme despite the evidence of discrimination. Republican political strategist Lee Atwater, in a discussion with political science professor Alexander Lamis, discusses the Republican strategy of using racism to win elections. Lamis will later quote Atwater in his book Southern Politics in the 1990s. Atwater takes Lamis through the evolution of Republican appeals to racism: “You start out in 1954 by saying, ‘N_gger, n_gger, n_gger.’ By 1968 you can’t say ‘n_gger’—that hurts you. Backfires. So you say stuff like forced busing, states’ rights, and all that stuff. You’re getting so abstract now [that] you’re talking about cutting taxes, and all these things you’re talking about are totally economic things and a byproduct of them is [that] blacks get hurt worse than whites. And subconsciously maybe that is part of it. I’m not saying that. But I’m saying that if it is getting that abstract, and that coded, that we are doing away with the racial problem one way or the other. You follow me—because obviously sitting around saying, ‘We want to cut this,’ is much more abstract than even the busing thing, and a hell of a lot more abstract than ‘N_gger, n_gger.’” Atwater will go on to manage the 1988 presidential campaign of George H. W. Bush, where he will oversee the use of what is considered one of the most overtly racist campaign ads in modern history, the “Willie Horton” ad (see September 21 - October 4, 1988). Ben Klassen, the founder and leader of the Church of the Creator (COTC—see 1973), publishes a second book, The White Man’s Bible, which he markets as a “program for the survival, expansion, and advancement of the white race.” (Southern Poverty Law Center 9/1999) In his book, Klassen writes: “The n_ggers is [sic] the vital means of b_stardizing the White Race.… The Jews are therefore madly pushing a program of upgrading the n_ggers and pulling down the White.” Klassen writes that the only solution to this issue is for whites to ship African-Americans back to Africa, “drive the Jews from power and render them harmless,” and “hang the traitors of our own race.” He continues his attack on non-whites by writing: “Today’s Black Plague is spelled n_ggers.… We regard them as subhuman or humanoid.… The most deadly threat the White Race faces is the tremendous expansion of the mud races led by the arch-enemy—the treacherous Jew.… We… declare everlasting war on the Jews, a war to the finish, until we have expelled them from all the lands inhabited by the white race.” (Anti-Defamation League 1993; Chip Berlet 2004)
The Aryan Nations compound in Hayden Lake, Idaho, owned by organization leader Richard Butler (see Early 1970s), is bombed. The church suffers $80,000 in damages. The bombing is never solved. Butler blames the Jewish Defense League for the attack, and responds by building a two-story guard tower on the property along with posting armed guards and dogs around the perimeter. Richard Butler, the head of the white separatist and neo-Nazi organization Aryan Nations (see Early 1970s), hosts the first Aryan World Congress at the Nations compound in Hayden Lake, Idaho. The event attracts many of the area’s racist leaders. Butler begins holding more gatherings in subsequent years and begins appointing state leaders of Aryan Nations chapters. One of the brightest young leaders in Butler’s coterie is Robert Jay Mathews, who will go on to found the violent white supremacist group The Order (see Late September 1983). Other prominent Nations members at the conferences include: Tom Metzger, leader of the White Aryan Resistance; Louis Beam, a former Klansman who will promote the concept of “leaderless resistance” (see February 1992); Don Black, a former Klansman who will create Stormfront, the largest white separatist forum on the Internet; and Kirk Lyons, a well-known lawyer who will represent a number of extremists facing criminal charges. Two of three mercenaries accused of plotting to overthrow the government of the tiny Caribbean island nation of Dominica are found guilty of conspiracy and violation of the Neutrality Act. Stephen Don Black, a prominent Alabama Ku Klux Klan leader, and Joe Daniel Hawkins, a Klansman from Mississippi, are found guilty of the charges. Both are found not guilty of violating five firearms statutes. The plot began in 1979, when the neighboring island country of Grenada was taken over by a socialist regime with ties to the Communist government of Cuba’s Fidel Castro. Mike Perdue, a former Marine and prominent white supremacist, discussed retaking Grenada with ousted former Prime Minister Eric Gairy. Perdue sought out Klan Imperial Wizard David Duke, who put him in touch with white supremacist Donald Clarke Andrews, then living in Canada. Andrews had led the white supremacist group Western Guard, and after serving a jail sentence for neo-Nazi activities, founded a new pro-Aryan group, the Nationalist Party of Canada. Andrews convinced Perdue that Dominica might be a good place from which to stage a coup in Grenada. Dominica was in the grip of grinding poverty, having been devastated by a hurricane in 1979 and plagued with racial violence from a splinter group of Rastafarians called the Dreads. The island’s government was unstable and, Perdue and Andrews believed, ripe for overthrow. Perdue partnered with another supremacist, Wolfgang Droege, and began planning to stage a coup that would place former Prime Minister Patrick John back in power. Even though John was something of a leftist, and wanted to displace the much more right-wing and pro-American Prime Minister, Eugenia Charles, in September 1980 Perdue and John agreed in writing to commence what they called “Operation Red Dog,” a violent coup with the goal of placing John back in charge of the government. The Washington Times will later report: “The coup forged some odd alliances. [It] united right-wing North Americans and Caribbean leftists, white nationalists and black revolutionaries; First World capitalists and Third World Socialists.” Canadian writer Stewart Bell later describes Perdue as a man of no real political convictions and a lust for money who routinely lies about his Vietnam experience (he never served in Southeast Asia, and did not tell his companions that he was a homosexual), and Droege as a German-Canadian high school dropout with neo-Nazi sympathies. Others involved in the putative coup are nightclub owner and white supremacist Charles Yanover, gunrunner Sydney Burnett-Alleyne (who supplied the initial connection to John), Black, Hawkins, and a small number of others. The mercenaries’ plan was to put John back in power; in return, John would give them license to use the island as a haven for casinos, drug smuggling, and money laundering. Almost from the outset, the conspiracy was infiltrated by two agents from the Bureau of Alcohol, Tobacco and Firearms (BATF), John Osburg and Wally Grafton, who were alerted to the planned coup by charter boat captain Mike Howell. Perdue had tried to hire Howell to take the mercenaries to Dominica, and told Howell that his was a CIA operation. Members of the operation also talked to others about it; one even gave a “secret” interview to a radio reporter in Hamilton. Osburg and Grafton alerted law enforcement authorities; on the night of the raid, federal authorities overwhelmed the small band of mercenaries, arrested them all, and confiscated a large number of firearms, 10 pounds of dynamite, over 5,000 rounds of ammunition, and a large red-and-black Nazi flag. The operation was later derisively termed the “Bayou of Pigs,” a joking reference to the 1961 attempt by right-wing American mercenaries to overthrow Castro’s government. John was arrested in Dominica. Perdue and six other participants have already pled guilty to violating the Neutrality Act. Before his sentencing of three years in prison, Black says, “What we were doing was in the best interests of the United States and its security in the hemisphere, and we feel betrayed by our own government.” (Time 5/11/1981; United Press International 6/21/1981; Abel 2/19/1998; Weisman 10/5/2008; Winnipeg Free Press 11/2/2008) After serving his jail term, Black will go on to found the influential white supremacist organization Stormfront (see March 1995 and June 22, 2008).
Ben Klassen, the founder and leader of the Church of the Creator (COTC—see 1973), moves the church from Florida to a large lot in Mulberry, North Carolina, opening a post office box in nearby Otto. He chooses the site because he believes Florida is too dangerous to live in. “I think South Florida is due for a lot of turmoil when bloody fighting breaks out,” he says. “Actually, I expect the financial collapse of the entire country, and blood will be flowing in the streets.” He and fellow COTC members build a personal residence, a three-story church, a small warehouse, and a “school for gifted boys.” Klassen begins calling himself “Pontifex Maximus” of the church, a Latin term meaning “high priest,” and begins writing a newsletter, “Racial Loyalty.” Later in the year, COTC is granted an exemption from state taxes based on its status as a church. (Anti-Defamation League 1993; Southern Poverty Law Center 9/1999) In the years to come, the Mulberry site will become a full-fledged “compound.” A September 1992 article in Mirabella magazine will observe that the “seventeen-acre landscaped compound… includes small-arms firing ranges, paramilitary barracks, and other buildings.… Inside a large converted barn that serves as headquarters, church founder and leader, Ben Klassen… sits beneath a large painted portrait of Adolf Hitler, ‘The greatest leader the white race ever had,’ says Klassen.… Since 1990 groups of committed young men have traveled here for extensive political mining under Klassen’s tutelage. The recruits wear white berets or cowboy hats, live in the barracks, and practice shooting with automatic weapons on the firing range. Many are older teenagers. ‘Exceptional boys,’ Klassen calls them.” (Anti-Defamation League 1993)
The Dartmouth Review, a conservative weekly student newspaper funded by off-campus right-wing sources (see 1980), runs an article opposing affirmative action that many feel is blatantly racist. The article is titled “Dis Sho’ Ain’t No Jive, Bro,” written by former Review chairman Keeney Jones. The article is the third in a series of attacks on affirmative action by Jones; the earlier articles featured Jones wishing he could medically darken his skin so he could get into medical school, and his claim that he was taking speech lessons to learn how to speak “black.” This article is written entirely in Jones’s version of “black dialect,” and features the following selection: “Dese boys be sayin’ dat we be comin’ to Dartmut’and not takin’ the classics. You know, Homa, Shakesphere; but I hes’ dey all be co’d in da gound, six feet unda, and whatcha be askin’ us to learn from dem? We culturally ‘lightened, too. We be takin’ hard courses in many subjects, like Afro-Am studies, women’s studies, and policy studies. And who be mouthin’ ‘bout us not bein’ good road? I be practicly knowin’ ‘Roots’ cova to cova, ‘til my mine be boogying to da words! And I be watchin’ the Jeffersons on TV ‘til I be blue in da face.” Upon receiving the article, Review board member Jack Kemp (R-NY), a Republican congressman, resigns from the board, saying Kenney’s article “relied on racial stereotypes” and undoubtedly offended many readers. “I am even more concerned that others found in it some support for racist viewpoints,” Kemp continues, and concludes: “I do not want my name to appear in your paper. I am concerned that the association of my name with the Dartmouth Review is interpreted as an endorsement and I emphatically do not endorse the kind of antics displayed in your article.” The Review appears unmoved by Kemp’s resignation, with editors saying they hope to replace him with televangelist Jerry Falwell. Editor Dinesh D’Souza says the paper bears no responsibility for any allegations of racism, and tells a New Hampshire reporter, “It is not the Dartmouth Review but the Afro-American Society which is the primary cause of racial tension on campus.” The undergraduate council and the faculty later votes to condemn the Review for creating a racially divisive atmosphere; Dartmouth’s president will write a letter saying the Review performs “offensive practices,” but that the issue cannot be solved by “violence or intolerance.” (Waligore 9/20/2006)

Posse Comitatus (see 1969 and 1983) member and anti-tax protester Gordon Kahl (see 1967 - 1973) and three Posse members gun down two US marshals who are attempting to arrest Kahl in a confrontation near Medina, North Dakota. The two marshals are among a group of six attempting to apprehend Kahl in a 1977 income tax case after he violated his probation by refusing to file a tax return (see 1975 - 1981); he has been a fugitive since 1981.
Initial Attempts to Negotiate Peaceful Surrender Fail - In that year, Kahl refused to turn himself over to North Dakota federal marshal Harold “Bud” Warren after a number of telephone conversations in which Kahl insisted that he had been “illegally” convicted by the “forces of Satan.” Warren decided that Kahl’s probation violation was “hardly a serious crime” and decided not to pursue it, partially because he knew Kahl was a crack shot and feared he would lose officers in any attempt to arrest him.
Increasing Involvement in Posse Activities - Kahl moved to Arkansas, where he visited the compound of the white supremacist Covenant, Sword, and Arm of the Lord organization. A member of that organization, Leonard Ginter, hid Kahl from federal authorities. Kahl’s wife, under tremendous stress from the situation, tried and failed to negotiate a settlement with the IRS, resulting in her excoriation by her 23-year-old son Yorie, who accused her of cooperating with “the tithing collectors of the Jewish-Masonic Synogogue [sic] of Satan.” Kahl became more and more involved in Posse Comitatus activities, traveling to Kansas and Colorado.
Return to North Dakota, Confrontation with Police - In January 1983 he and Yorie Kahl returned to North Dakota with the intention of setting up a Posse “township” near Medina, which they envisioned as being free from state and government control. Kahl’s station wagon is observed by Stutsman County deputy sheriff Bradley Kapp, who informs the Marshal Service in Bismarck. Warren’s successor, Kenneth Muir, authorizes Kahl’s arrest, and drives to Medina with Deputy Marshal Carl Wigglesworth to join two other deputy marshals, Robert Cheshire Jr. and James Hopson Jr. Kapp is spotted by some of his Posse colleagues, who quickly join him in planning to forcibly resist any arrest attempt. Reportedly, they receive the assistance of Medina police chief Darrell Graf, who is allegedly a Posse sympathizer. Kahl, Yorie Kahl, and Posse members David Broer and Scott Faul flee Medina in two Posse members’ cars, but the ruse only briefly confuses the marshals, and two police cars with flashing lights quickly apprehend Kahl and Broer. One car is driven by deputy police chief Steve Schnabel; the other by Muir and Wigglesworth. Kapp, Cheshire, and Hopson are close behind in a third vehicle. Kahl and Broer turn off the road into a driveway, and Kahl, armed with a modified Ruger Mini-14 assault rifle, prepares to open fire on the approaching police officers. The others leap out of their cars and, armed with Mini-14s, take up positions in a ditch. When the marshals arrive moments later, they get out of their cars and order the Posse members to lay down their weapons. One of the Posse members opens fire, and in the 30-second volley that ensues, Kahl and his fellow Posse members lay down a deadly fire that inflicts heavy damage on the outgunned marshals. Kahl wounds Kapp and Schnabel with two shots, and kills Muir with a shot to the heart. Muir fires off a single shot that gravely wounds Yorie. Hopson is struck in the head by a ricocheting bullet that causes permanent brain damage. Rifle fire from Yorie and Faul fatally wounds Cheshire. Kapp, severely injured, manages to shoot Yorie three more times, then takes cover. Kahl executes the dying Cheshire with a shot to the head, then points his rifle at the downed Schnabel, but chooses not to kill him, instead taking his police cruiser and fleeing the scene. He takes the injured Yorie to a Posse member, Dr. Clarence Martin; Yorie and Kahl’s wife Joan are arrested later that night at the hospital, and Yorie tells FBI agents some details of the confrontation. Faul, Broer, and Posse member Vernon Wegner are also arrested; Faul refuses to tell police or FBI investigators where Kahl might have fled to. Police find Schnabel’s abandoned police cruiser. Two days later, police surround Kahl’s farmhouse and bombard it with tear gas, only to find it abandoned. They do find a store of weapons and ammunition, and a collection of Posse Comitatus pamphlets and related documents. Kahl’s family insists that law enforcement efforts to apprehend Kahl are unfair, and complain that he is being “hunted like a dog.” Joan Kahl appears on television and tearfully pleads with her husband to surrender, to no avail. FBI and US Marshals descend on the local Posse Comitatus headquarters, and offer a $25,000 reward for information leading to his arrest, but Kahl has disappeared into the shadows of the far-right militia network. (Ian Geldard 2/19/1995; Southern Poverty Law Center 12/2001; Levitas 2002, pp. 194-200; Nicole Nichols 2003; Anti-Defamation League 2011) Kahl’s murder of the marshals will be used by Posse Comitatus leader James Wickstrom to promote the anti-tax movement (see February 14-21, 1983). Four months later, Kahl will die in a bloody standoff with police officers in Arkansas (see March 13 - June 3, 1983).
Robert Jay Mathews, a white supremacist and activist (see 1980-1982 and September 1983), invites eight men to his property in Metaline Falls, Washington: neighbor and best friend Kenneth Loft; former Ku Klux Klansman David Edan Lane; Daniel Bauer; Denver Daw Parmenter; Randolph George Duey and Bruce Carroll Pierce of the Aryan Nations; and National Alliance recruits Richard Harold Kemp and William Soderquist. Mathews and his eight guests found a new organization called, variously, “The Order,” “The Silent Brotherhood” or “Bruder Schweigen,” and “The White American Bastion.” The group uses the story depicted in the novel The Turner Diaries as its framework, determining to use violence and crime to destabilize the US government and establish a whites-only society. In the novel, “The Organization” finances its revolution by armed robberies, counterfeiting, and other crimes designed to disrupt the US economy. Mathews decides his group will use the same plan. Mathews is also inspired by real crimes, such as a failed 1981 armored car heist by the Black Liberation Army. (Kushner 2003, pp. 222-223; McClary 12/6/2006)
Members of the white separatist, anti-Semitic group Posse Comitatus (see 1969) begin to drift away from the group after federal and state authorities seize the “township” of Tigerton Dells, Wisconsin, which the group has created as part of its “breakaway” nation. The organization is also destabilized by negative media attention after one of its members, Gordon Kahl, killed two US marshals and was later killed himself in a violent confrontation with federal and state officials in Arkansas (see February 13, 1983 and After). Some of the Posse members will take up membership in other white supremacist Christian Identity (see 1960s and After) groups such as Aryan Nations (see Early 1970s). The organization will not entirely dissipate, but quickly loses influence and membership (from a height of some 50,000) to newer groups. James Wickstrom, the counterinsurgency director of the anti-Semitic, anti-government group Posse Comitatus (see 1969), escapes from federal custody after being convicted of running an illegal guerrilla training camp in the Posse’s “planned community” of Tigerton Dells, Wisconsin. Wickstrom, a former tool salesman who protested the Vietnam War on the grounds that it was being fought for “Jew bankers,” and who has successfully recruited Michigan farmers for his group, promises the Posse’s enemies—primarily federal agents and Jews—“the biggest bloodbath you can imagine” before his capture. (Nicole Nichols 2003; Southern Poverty Law Center 12/2004; Southern Poverty Law Center 2010) Wickstrom is captured and will spend a year in prison; Tigerton Dells is seized and many Posse members arrested (see 1984). In 1990, Wickstrom will be sentenced to over three years in prison for counterfeiting currency and illegally possessing firearms. After his second and final release, he will become a popular speaker at neo-Nazi gatherings, where he will tell listeners that he lives “for the day I can walk down the road and see heads on fence posts.” Wickstrom will become chaplain of the Christian Identity separatist group Aryan Nations, and will go on to broadcast a weekly Internet radio program called “Yahweh’s Truth.” (Southern Poverty Law Center 2010)
Robert Jay Mathews, the leader of the white supremacist group The Order (see August 1984 and After) and a fugitive from justice, pens a four-page “Declaration of War” while recuperating from a minor gunshot wound (see November 23-24, 1984). The letter accuses the FBI of trying to force him to leave his job as an electrician in Metaline Falls, Washington (see 1980-1982), and blames the FBI’s interest in him on his “involvement in the Tax Rebellion Movement from the time I was 15 to 20 years old” (see 1973). Mathews writes of his “thorough disgust… with the American people,” whom he says have “devolved into some of the most cowardly, sheepish, degenerates that have ever littered the face of this planet.” He writes that once he realized “White men” or “Aryans” are the only proper leaders and inhabitants of the US, he determined to take action to “cleanse” the nation of “Mexicans, mulattoes, blacks, and Asians.” Mathews writes of his belief that “a small, cohesive alien group within this nation” with “an iron grip on both major political parties, on Congress, on the media, on the publishing houses, and on most of the major Christian denominations in this nation” are working to ensure that whites become an oppressed and subservient minority in America. Now, he says, the US government “seems determined to force the issue, so we have no choice left but to stand and fight back. Hail Victory!” Mathews denies that his colleague Gary Yarborough fired at FBI agents during those agents’ attempts to secure evidence at Yarborough’s mountain cabin (see October 18, 1984), falsely claims that during the incident, FBI agents “used Gary’s wife as a shield and a hostage and went into the house,” and claims that Yarborough chose not to kill a number of agents, but instead to flee without further violence. He claims that the FBI attempted to “ambush” him at a Portland motel (see November 23-24, 1984), and that FBI agents accidentally gunned down the motel manager in an attempt to shoot Mathews in the back. He also claims that he could have easily killed the FBI agent he shot at the motel, but chose to spare his life, shooting him in the leg instead. Mathews further asserts that FBI agents threatened his two-year-old son and his 63-year-old mother in their attempts to locate him. He declares that he is not going into hiding, but instead “will press the FBI and let them know what it is like to become the hunted.” He writes that he may well die soon, and concludes: “I will leave knowing that I have made the ultimate sacrifice to ensure the future of my children. As always, for blood, soil, honor, for faith, and for race.” The letter “declares war” against the “Zionist Occupation Government of North America,” and calls for the murder of politicians, judges, and any other authority figures who interfere with The Order’s attempt to overthrow the government and exterminate other races. It concludes, “Let the battle begin.” (Robert Jay Mathews 12/1984; McClary 12/6/2006)
William Pierce, the founder of the neo-Nazi National Alliance (see 1970-1974) and the author of the inflammatory and highly influential white supremacist novel The Turner Diaries (see 1978), purchases a large farm near Mill Point, West Virginia, for $95,000. Some will suggest that the money Pierce uses to buy the farm comes from armed robberies carried out by The Order (see Late September 1983), but those suggestions will remain unproven. Pierce and his followers will transform the farm into a large, fortified compound that serves as the Alliance’s national headquarters. (Center for New Community 8/2002 )
Two anti-tax protesters, William “Bill” Benson and Martin J. “Red” Beckman, publish a two-volume book, The Law that Never Was, that argues the 16th Amendment, the constitutional amendment giving the federal government the authority to levy income taxes, is null and void (see 1951-1967, 1970-1972, 1976-1978, and Early 1980s). The arguments in the book include the idea that because the amendment was ratified by different states with small differences in capitalization and punctuation, it was never properly ratified, as well as the argument that since Ohio was not yet a state when it ratified the amendment, Ohio’s ratification of the amendment renders it null. The authors include other arguments—the Internal Revenue Code is not “positive law”; the Internal Revenue Service is not a legitimate government agency; wages do not qualify as “taxable income”; “sovereign citizens” are exempt from income tax—all of which will be declared worthless and frivolous by various state and federal courts. The Anti-Defamation League will write that the arguments advanced by Benson and Beckman “are used again and again by tax protesters.… When a tax protest argument fails in court, the response among tax protesters is typically not to conclude that the argument was erroneous but rather to assume that the judge was wrong, corrupt, or deliberately misinterpreting the law.” Benson is a former investigator for the Illinois Internal Revenue Service, while Beckman is a virulent anti-Semite who accuses Jews of worshiping Satan and says the Holocaust was God’s “judgment upon a people who believe Satan is their god.” In 1991, Benson will be convicted of tax fraud and tax evasion, and will be sued by the US government to stop him from promoting an “abusive tax shelter” by selling what he calls a “Reliance Defense Package” while doing business as “Constitutional Research Associates.” In 2007, a federal court will find that his Reliance Defense Package “contained false or fraudulent information concerning tax advice,” and will note that a circuit court “explicitly rejected Benson’s arguments that the Sixteenth Amendment was not properly ratified.” Benson’s work will frequently be cited by tax protesters, many of whom will be fined or convicted for relying on his claims. Dennis Ryan, 15, helps his father torture and kill a man. Michael Ryan, a partially disabled farmer in Rulo, Nevada, has for three years followed the violent white supremacist teachings of the Posse Comitatus (see 1969) through Posse leader James Wickstrom (see 1975 - 1978), who in 1982 told him to prepare for Armageddon. After speaking to Wickstrom for the first time in Kansas, Ryan told his son to quit playing football and begin practicing with a rifle. Wickstrom adopted Ryan as something of a protege, and steered some of his supporters towards him, making him a leader in local Posse circles. In 1985, Dennis, on his father’s orders, shoots James Thimm in the face. His father had become angry with Thimm. When Thimm does not die, the elder Ryan chains him inside a hog shed, kicks and beats him, and forces him to have sex with a goat. Dennis, again complying with his father’s orders, shoots off Thimm’s fingers and partially skins him. The elder Ryan sodomizes Thimm with a shovel and finally kicks him to death. The entire procedure takes two weeks. In 2001, Dennis Ryan will tell a reporter: “I don’t hold Wickstrom responsible for the crime I committed. I hold him responsible for getting my dad into it.… Wickstrom didn’t make my dad kill anybody, but he planted the seed. He planted it in my dad and then he helped it grow.” Author Daniel Levitas will agree, telling the reporter, “There could not have been the tragedy in Rulo if there was not a James Wickstrom.” Dennis Ryan wil add: “He was looking for something to believe in. He didn’t like blacks to begin with. I don’t think he was ever a popular person growing up. I think that it was the right time for the wrong thing. He was weak and you don’t let someone indoctrinate you into something like that unless you are weak-minded. He was all screwed up.” Former Covenant, Sword and Arm of the Lord member Kerry Noble will say of Wickstrom: “[He] is dangerous to the extent of provoking others. He is typical of leaders. They won’t do violent stuff, yet that’s all they’ll preach. They’ll push buttons, but they are extremely cowardly.” Dennis will recall: “Jim Wickstrom was the reason Dad got into this stuff. He’s the one who showed Dad how to talk to Yahweh, the reason we started getting guns and preparing for Armageddon. He was always so amazed at all the weaponry and how well Jim Wickstrom and his followers in Tigerton Dells (see 1978 - 1983) were armed.” After moving from Whiting, Kansas, to a farm in Rulo, Ryan ordered his family to steal farm equipment, livestock, and weapons in the name of Yahweh. Dennis will recall that the crimes were based on Wickstrom’s teachings, saying: “We were supposed to kill all Satan’s people. Dad was supposed to be the King of Israel and I was the Prince. He was supposed to die before the New Jerusalem was brought down from Yahweh, and then I’d be the king. I believed it 110 percent. All the way. Hell, I helped kill a man for it, and I never once questioned it.… Wickstrom wasn’t physically a constant presence in our lives, he wasn’t over all the time at the house or always on the phone with my dad, but he was there in that he was Dad’s teacher. We had all of his fliers and cassettes. Dad would even listen to Wickstrom while he was taking the garbage out.” Dennis will say that by 1985 Ryan had become obsessed with religious fervor and his conviction that Armageddon was imminent. He became more and more violent, focusing much of his rage on Luke Stice, the five-year-old son of follower Rick Stice, whom he savagely abused until March 1985, when he broke Luke’s neck. Rick Stice helped Ryan bury his child. Dennis will serve a 12-year prison sentence for his role in the death of James Thimm. Michael Ryan will be sentenced to death. Dennis, after serving his sentence, starting a family, and becoming a carpenter, will have no further contact with his father. He has little trust in organized religion. He says: “I look at the Bible and it scares me because I know how people twist it and use it for their own benefit. I don’t want some man up there telling me what God expects of me. I was told that before, and I killed someone.… So many people interpret the Bible so many different ways. I mean, take 9/11. That’s their religious beliefs. They’re no different than what my dad did except they actually carried it out. As far as killing thousands of people—that was his goal, too.” (Southern Poverty Law Center 12/2004)
Richard Scutari, one of two members of the now-defunct white supremacist group The Order to escape the government’s massive prosecution of the group’s members (see Late December 1984 - April 1985), is arrested without incident at a brake shop in San Antonio, Texas, where he has worked for months; he is carrying a .45 caliber pistol but does not use it. Scutari has been on the FBI’s Most Wanted List since September 1985. He will plead guilty to racketeering, conspiracy, and armed robbery charges, and will be sentenced to 60 years in federal prison. During his trial, he will tell the court, “I had no choice but to strike out against a satanic government.” Scutari will become a hero of the radical right while in prison, some of whom will call him a “prisoner of war.” (Eye on Hate 2003; McClary 12/6/2006)
Campaigning on behalf of conservative Republican candidates in an attempt to have the GOP retain control of the Senate, Ronald Reagan goes on a campaign tour of the South, where he alludes to Republicans’ plans for exerting control of the nation’s court system. Typical of Reagan’s stump speech is the following one he delivers on behalf of embattled Republican incumbent James Broyhill: “Since I’ve been appointing federal judges to be approved by people like Jim Broyhill in the Republican Senate, the federal judiciary has become tougher, much tougher, on criminals. Criminals are going to jail more often and receiving longer sentences. Over and over the Democratic leadership has tried in the Senate to torpedo our choices for judges. And that’s where Jim Broyhill can make all the difference. Without him and the Republican majority in the Senate, we’ll find liberals like Joe Biden and a certain fellow from Massachusetts deciding who our judges are. And I’ll bet you’ll agree; I’d rather have a Judiciary Committee headed by Strom Thurmond than one run by Joe Biden or Ted Kennedy.” Broyhill will be defeated, and Democrats will regain control of the Senate in spite of Reagan’s efforts, in large part because of Southern blacks offended by such speeches. The new Democratic leadership, responding to the voters, will help block the racially questionable Robert Bork’s nomination to the Supreme Court (see July 1-October 23, 1987). (Dean 2007, pp. 140)
William Pierce, the founder of the neo-Nazi National Alliance (see 1970-1974) and the author of the inflammatory and highly influential white supremacist novel The Turner Diaries (see 1978), oversees the creation of a publishing firm for the Alliance, National Vanguard Books. It will publish a number of works, most prominently a reprint of The Turner Diaries and Pierce’s second novel, Hunter, which tells the story of a white assassin who kills minorities, particularly interracial couples. He dedicates Hunter to Joseph Paul Franklin, convicted of the sniper murders of two African-American men (see 1980). Pierce will later tell his biographer that he wrote Hunter as a deliberate motivational tool for assassins, saying, “From the beginning with Hunter, I had this idea of how fiction can work as a teaching tool in mind.” In 2002, the Center for New Community will write, “Like The Turner Diaries, the book has inspired several real-life acts of racist terror” (see January 4, 2002 and After). In 1991, National Vanguard will expand into releasing audiotapes, which by December 1992 will spawn a radio show, American Dissident Voices. In 1993, it will begin publishing comic books targeted at children and teenagers. (Center for New Community 8/2002 )
Ben Klassen, the founder and leader of the Church of the Creator (COTC—see 1973), publishes another book, this one titled Rahowa! This Planet is All Ours. The term “rahowa” is short for the COTC “battle cry” RAcial HOly WAr. In the book, Klassen declares: “RAHOWA! In this one word we sum up the total goal and program of not only the Church of the Creator, but of the total White Race, and it is this: We take up the challenge. We gird for total war against the Jews and the rest of the g_ddamned mud races of the world—politically, militantly, financially, morally, and religiously. In fact, we regard it as the heart of our religious creed, and as the most sacred credo of all. We regard it as a holy war to the finish—a racial holy war. Rahowa! is INEVITABLE. It is the Ultimate and Only solution.” Klassen predicts: “No longer can the mud races and the White Race live on the same planet and survive. It is now either them or us. We want to make damn sure it is we who survive. This planet is from now on all ours, and will be the one and only habitat for our future progeny for all time to come.” (Anti-Defamation League 1993)
A political advertisement on behalf of the George H. W. Bush presidential campaign appears, running on televisions around the country between September 21 and October 4, 1988. Called “Weekend Pass,” it depicts convicted murderer William “Willie” Horton, who was granted 10 separate furloughs from prison, and used the time from his last furlough to kidnap and rape a young woman. The advertisement and subsequent media barrage falsely accuses Democratic presidential candidate Michael Dukakis, the governor of Massachusetts, of creating the “furlough program” that led to Horton’s release, and paints Dukakis as “soft on crime.” It will come to be known as one of the most overly racist political advertisements in the history of modern US presidential politics.
Ad Content - The ad begins by comparing the positions of the two candidates on crime. It notes that Bush supports the death penalty for convicted murderers, whereas Dukakis does not. The ad’s voiceover narrator then states, “Dukakis not only opposes the death penalty, he allowed first-degree murderers to have weekend passes from prison,” with the accompanying text “Opposes Death Penalty, Allowed Murderers to Have Weekend Passes” superimposed on a photograph of Dukakis. The narrator then says, “One was Willie Horton, who murdered a boy in a robbery, stabbing him 19 times,” accompanied by a mug shot of Horton. The voiceover continues: “Despite a life sentence, Horton received 10 weekend passes from prison. Horton fled, kidnapped a young couple, stabbing the man and repeatedly raping his girlfriend.” At this point, the ad shows another picture of Horton being arrested while the accompanying text reads, “Kidnapping, Stabbing, Raping.” The ad’s narration concludes: “Weekend prison passes. Dukakis on crime.” The ad is credited to the “National Security Political Action Committee.” (Inside Politics (.org) 1999; Museum of the Moving Image 2008; Cross 11/18/2009)
'Soft on Crime' - The ad is a reflection of the measures the Bush campaign is willing to undertake to defeat the apparently strong Dukakis candidacy. Dukakis is a popular Democratic governor and widely credited with what pundits call the “Massachusetts Miracle,” reversing the downward economic spiral in his state without resorting to hefty tax increases. At the time of the ad, Dukakis enjoys a 17-point lead over Bush in the polls. Bush campaign strategists, led by campaign manager Lee Atwater, have learned from focus groups that conservative Democratic voters, which some call “Reagan Democrats,” are not solid in their support of Dukakis, and are swayed by reports that he vetoed legislation requiring teachers to say the Pledge of Allegiance at the beginning of the school day. They also react negatively when they learn that during Dukakis’s tenure as governor, Horton had been furloughed and subsequently raped a white woman. Atwater and the Bush campaign decide that Dukakis can successfully be attacked as a “liberal” who is “not patriotic” and is “soft on crime.” Atwater, who has a strong record of appealing to racism in key voting groups (see 1981), tells Republican Party officials, “By the time this election is over, Willie Horton will be a household name.” Although Dukakis had vetoed a bill mandating the death penalty for first-degree murder in Massachusetts, he did not institute the furlough program; that was signed into law by Republican governor Francis Sargent in 1972. The ads and the accompanying media blitz successfully avoid telling voters that Sargent, not Dukakis, instituted the furlough program. (Simon 10/1/1990; Inside Politics (.org) 1999)
Running the Horton Ad - The ad is sponsored by an ostensibly “independent” political organization, the conservative National Security Political Action Committee (NSPAC), headed by former Chairman of the Joint Chief of Staff Thomas Moorer. NSPAC’s daughter organization “Americans for Bush” actually put together the ad, created by marketer Larry McCarthy in close conjunction with Atwater and other Bush campaign aides; Atwater determined months before that the Horton ad should not come directly from the Bush campaign, but from an “independent” group supporting Bush, thus giving the Bush campaign the opportunity to distance itself from the ad, and even criticize it, should voters react negatively towards its message (see June-September 1988). The first version of the ad does not use the menacing mug shot of Horton, which McCarthy later says depicts “every suburban mother’s greatest fear.” McCarthy and Atwater feared that the networks would refuse to run the ad if it appeared controversial. However, the network censors do not object, so McCarthy quickly substitutes a second version of the ad featuring the mug shot. When Democrats and progressive critics of the Bush campaign complain that Bush is running a racist ad, Bush media adviser Roger Ailes says that neither he nor the campaign have any control over what outside groups like “Americans for Bush” put on the airwaves. InsidePolitics will later write, “This gave the Bush camp plausible deniability that helped its candidate avoid public condemnation for racist campaigning.”
Accompanying Newspaper Reports, Bush Campaign Ads - The ad airs for the first time on September 21. On September 22, newspapers around the nation begin publishing articles telling the story of Angie and Clifford Barnes, victimized by Horton while on furlouogh. On October 5, the Bush campaign releases a “sister” television ad, called “Revolving Door.” Scripted by Ailes, the commercial does not mention Horton nor does it show the now-infamous mug shot, but emphasizes the contention that Dukakis is “soft on crime” and has what it calls a “lenient” furlough policy for violent convicts. The central image of the ad is a stream of African-American inmates moving slowly in and out of a revolving gate. The voiceover says that Dukakis had vetoed the death penalty and given furloughs to “first-degree murderers not eligible for parole. While out, many committed other crimes like kidnapping and rape.” At the same time, Clifford Barnes and the sister of the youth murdered by Horton embark on a nationwide speaking tour funded by a pro-Bush independent group known as the Committee for the Presidency. Barnes also appears on a number of television talk shows, including those hosted by Oprah Winfrey and Geraldo Rivera. Barnes and the victim’s sister also appear in two “victim” ads, where Barnes says: “Mike Dukakis and Willie Horton changed our lives forever.… We are worried people don’t know enough about Mike Dukakis.” In 1999, InsidePolitics will write that the media gives the “Revolving Door” ad a “courteous reception,” and focuses more on the two ads’ impact on the election, and the Dukakis campaign’s lack of response, instead of discussing the issues of race and crime as portrayed by the ads. It is not until October 24, less than two weeks before the election, that anyone in the mainstream media airs footage of critics questioning whether the ads are racially inflammatory, but these appearances are few and far between, and are always balanced with appearances by Bush supporters praising the campaign’s media strategy. Denials - Bush and his vice presidential candidate Dan Quayle will deny that the ads are racist, and will accuse Democrats of trying to use racism to stir up controversy (see October 1988).
Failure to Respond - The Dukakis campaign will make what many political observers later characterize as a major political blunder: it refuses to answer the ads or dispute their content until almost the last days of the campaign, hoping that viewers would instead conclude that the ads are unfair without the Dukakis campaign’s involvement. The ads will be hugely successful in securing the election for Bush (see September-November 1988). (Museum of the Moving Image 2008)
The “Willie Horton” ad campaign, a pair of ads launched by an “independent” organization on behalf of the Bush re-election campaign and by the Bush campaign itself (see June-September 1988 and September 21 - October 4, 1988), is considered an immediate success by veteran political observers, in spite of what many call its overtly racist appeal. Because the first ad, “Weekend Pass,” was the product of an ostensibly independent organization, the Bush campaign is able to keep a distance between itself and the ad. In the last weeks of the campaign, some polls show that voters blame President Bush and Democrat Michael Dukakis almost equally for the negative tone of the campaign. While the ads only ran a relatively small number of times, news networks run the ads repeatedly, often adding their own analysis while the images of the ads run in the background. According to InsidePolitics, only once does any journalist challenge the “deceptive information from Bush’s crime ads.… By amplifying Bush’s claims, news reporters gave the ads even greater legitimacy than otherwise would have appeared. News accounts quoted election experts who noted that Bush’s tactics were effective and that Dukakis’ failure to respond was disastrous. Because these assessments appeared in the high credibility framework of news broadcasts, they came across as more believable than had they been aired only as paid advertisements.” The “Weekend Pass” and “Revolving Door” ads have a palpable effect on the electorate, energizing voters who cite “law and order” as one of their major concerns for the nation, and driving many of them towards voting for Bush. Less discussed but equally powerful is the racial effect of the ads. Polls show that many white voters feel fearful because of the ads, and feel that Bush, not Dukakis, will make them safer from crime. InsidePolitics notes that the Bush campaign “had picked the perfect racial crime, that of a black felon raping a white woman.” Later research will show that many viewers saw the Horton case as more about race than crime; many subjects exposed to news broadcasts about the Horton case responded in racial terms, with studies finding that the ads “mobilized whites’ racial prejudice, not their worries about crime.” InsidePolitics will write: “Viewers became much more likely to feel negatively about blacks in general after having heard the details of the case. It was an attack strategy that worked well on several different levels for Republicans.” (Inside Politics (.org) 1999; Cross 11/18/2009) After the election, a New York Times voter poll will rate the “Revolving Door” ad as the single most influential ad of the campaign. The ad was particularly effective among white women, many of whom said that after watching it during the campaign, they began to view Bush as “stronger on crime” and as the candidate who would keep them “safer.” In 1999, InsidePolitics will write that voters often conflated the two ads, and it is unclear from poll responses whether they differentiated between the independently produced ad and the Bush campaign ad. InsidePolitics also notes the powerful impact of the Horton ad’s clear reference to rape. Dukakis’s campaign manager Susan Estrich will say: “The symbolism was very powerful… you can’t find a stronger metaphor, intended or not, for racial hatred in this country than a black man raping a white woman.… I talked to people afterward.… Women said they couldn’t help it, but it scared the living daylights out of them.” (Inside Politics (.org) 1999)
The “Willie Horton” (a.k.a. “Weekend Pass”) campaign ad, produced by an “independent” political organization on behalf of the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988), and the Bush campaign’s accompanying ad, “Revolving Door,” draw accusations from the Democratic challenger, Michael Dukakis, that they are racist in their appeals. President Bush denies the accusations that race has anything to do with the ads, or even that racism exists. He calls the Dukakis accusations “some desperation kind of move,” and says: “There isn’t any racism. It’s absolutely ridiculous.” Dukakis is leveling these accusations, Bush says, because he “is weak on crime and defense and that’s the inescapable truth.” Bush accuses Dukakis of lying about his record, and accuses the Democrat of both racist and sexist behavior, though he gives no details or evidence. Bush’s vice-presidential candidate, Dan Quayle, agrees, and accuses the Dukakis campaign of behaving in a racist manner, saying: “It’s totally absurd and ridiculous. I think it shows just how desperate they really are, to start fanning the flames of racism in this country.” Civil rights leader Jesse Jackson has accused the Bush campaign of trying to incite racial fears through the Horton ad, and Dukakis’s vice-presidential candidate, Lloyd Bentsen, says there seems to be “a racial element” in the Bush campaign’s strategy. In contrast to Bush’s denials, Bush media adviser Roger Ailes jokes with reporters about the ads, saying that the campaign’s only question about the Horton ad was whether to portray Horton “with a knife in his hand or without it,” and accuses Dukakis’s campaign of spreading racism about Hispanics in its own ads. Bush states that he is “fully behind” both the “Weekend Pass” and “Revolving Door” ads. (Dowd 10/25/1988)
Two Democratic organizations in Ohio file a complaint with the Federal Election Commission (FEC) in the matter of the now-infamous “Willie Horton” ads used to great effect by the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988). The complaint alleges that the ostensibly independent political organization that created and financed the first ad, the National Security Political Action Committee (NSPAC), violated the law on independent expenditures (see May 1990 and After). The complaint uncovers numerous connections between NSPAC and the Bush campaign. However, the FEC refuses to charge the Bush campaign with campaign finance violations. (Inside Politics (.org) 1999)
Richard Butler, the head of the white separatist and neo-Nazi organization Aryan Nations (see Early 1970s), commemorates the 100th birthday of Adolf Hitler by inviting white racists and separatists to the Hayden Falls, Idaho, compound of the organization for a celebration. The gathering, which features music by white power skinhead rock bands, is designed to reach out to younger whites. (Southern Poverty Law Center 2010)
African-American writer Anthony Walton writes for the New York Times Magazine his thoughts on the overtly racist “Willie Horton” ad campaign launched the year before by the Bush re-election campaign (see June-September 1988 and September 21 - October 4, 1988). Walton writes: “George Bush and his henchmen could not have invented Willie Horton. Horton, with his coal-black skin; huge, unkempt Afro, and a glare that would have given Bull Connor or Lester Maddox [infamous white supremacists who abused African-Americans in the 1950s and ‘60s] serious pause, had committed a brutal murder in 1974 and been sentenced to life in prison. Then, granted a weekend furlough from prison, had viciously raped a white woman in front of her fiance, who was also attacked. Willie Horton was the perfect symbol of what happened to innocent whites when liberals (read Democrats) were on the watch, at least in the gospel according to post-Goldwater Republicans. Horton himself, in just a fuzzy mug shot, gave even the stoutest, most open, liberal heart a shiver. Even me. I thought of all the late nights I had ridden in terror on the F and A trains, while living in New York City. I thought Willie Horton must be what the wolf packs I had often heard about, but never seen, must look like. I said to myself, ‘Something has got to be done about these n_ggers.’” Walton recounts several instances where he himself has been the victim of racism, and notes that in many eyes, he and Horton are interchangeable: “If Willie Horton would become just a little middle-class, he would look like me.… [I]n retrospect, I can see that racism has always been with me, even when I was shielded by love or money, or when I chose not to see it. But I saw it in the face of Willie Horton, and I can’t ignore it, because it is my face.” (Walton 8/20/1989)
James Wickstrom (see 1975 - 1978), the Posse Comitatus (see 1969) leader who recently spent over a year in prison for impersonating a public official (see 1983), is again sentenced to 38 months in prison for his role in a plot to print and distribute $100,000 in counterfeit bills for the 1988 Aryan Nations World Congress. The counterfeit bills were to help fund paramilitary activities. By the time Wickstrom is released in 1994, the Posse Comitatus has all but dissolved (see 1984). In 2001, author Daniel Levitas will say: “Wickstrom’s light has been fading ever since the compound at Tigerton Dells shut down (see 1983). Wickstrom’s heyday was in the period from 1978 to 1985. That was his period of peak influence. Since then he’s hopscotched around and been able to gather small groups of people around him, but he’ll never return to his former stature in the movement.” Wickstrom will continue speaking to small groups, selling his speeches through the mail and the Internet, and running an obscure weekly Internet-based radio show, which he will abandon in 2003. He will attempt to take leadership of a splinter faction of the disintegrating Aryan Nations organization (see 2003, 2004, and September 2004 and After). (Southern Poverty Law Center 12/2004)
Almost 2,500 protesters gather on the Dartmouth College green to protest the conservative, off-campus Dartmouth Review, a student newspaper given to extremes of racial and political rhetoric (see 1980). The protest is sparked by the Review’s recent publication of a selection of Nazi propaganda on Yom Kippur, one of the highest of Jewish holy days. The selection, printed on the paper’s masthead, was from Adolf Hitler’s book Mein Kampf, and read: “I therefore believe today that I am acting in the sense of the Almighty Creator: By warding off the Jews, I am fighting for the Lord’s work.” The protest is led by Dartmouth president James Freedman, and made up of a wide swath of students, faculty, and alumni. “This has been a week of infamy for the Dartmouth community,” Freedman says. “The Dartmouth Review has consistently attacked blacks because they are black, women because they are women, homosexuals because they are homosexuals, and Jews because they are Jews,” he says; two years before, the Review had compared Freedman, who is Jewish, to Hitler, and compared his policies to the Holocaust (see November 9-10, 1988). College trustees call the Hitler publication “a criminal act of sabotage.”
Trustee Accuses University President of Using Incident to 'Incite Hatred' - The Boston Globe describes Review trustee and former editor Dinesh D’Souza, a former policy adviser in the Reagan administration, as both “contrite and combative” over the incident. D’Souza apologizes for the publishing of the Hitler selection, then moments later accuses Freedman of using the incident to incite hatred against the Review. “This case is Dartmouth’s Tawana Brawley,” he says, referring to the 1987 case of a young African-American woman who some believe falsely accused several white men of raping her. “You have a sabotage, a hoax, a dirty trick that is being ruthlessly and cynically exploited by the college leadership in order to ruin the lives of many innocent students. President Freedman has emerged as the Al Sharpton of academia.” (Sharpton, a New York pastor and civil rights leader, was one of Brawley’s most public advocates.) Protesters line up one after another to urge the college to repudiate the newspaper. Dartmouth officials say that the newspaper has damaged the college’s reputation and diminished the school’s ability to recruit top students and faculty, particularly minorities. Religion professor Arthur Hertzberg calls the Hitler quote another “act of ongoing hooliganism” in a string of politically and racially explosive actions by the Review, and tells the crowd: “This is not a hating college. This is not an anti-Semitic college. This is not an institution of infamy. It is a community of warmth and love.”
Professor: Responsibility Lies with Conservative Funders - Hertzberg says his quarrel is not with “the 20 or 30 misguided young people who edit the Review.” Rather, he says, it is with the prominent conservatives who support the paper. The Review is financed mostly by off-campus, conservative organizations and foundations; it has an annual budget of some $150,000, and faces high legal bills. Hertzberg says the paper’s key backers include former Treasury Secretary William Simon; former Chase Manhattan Bank chairman George Champion; National Review editor William F. Buckley Jr.; and conservative commentator and former Nixon speechwriter Patrick Buchanan. “My quarrel is with those out there who put up hundreds of thousands of dollars a year with which to contaminate this campus,” Hertzberg says. “They should be ashamed of themselves.”
Board Member Accuses Liberals of Planting Hitler Quote - Review advisory board member George Gilder, a conservative economist, says the Hitler quote was planted by someone who wishes the newspaper ill: “Do you think any conservative in the world would deliberately put that into the magazine? It’s obviously an attack by somebody who infiltrated the ranks.” Gilder says Freedman and liberals at Dartmouth are using the Hitler incident “to try to kill the Review, just as they try to kill conservatism whenever it rises up on campus.” Editor in chief Kevin Pritchett collects the issues of the newspaper, and, with three other senior staffers, publishes an open letter denying any involvement in publishing the quote and accusing a staff “insider” of somehow inserting it. Review supporters in New York and Washington, DC, demand that the Anti-Defamation League (ADL) conduct an investigation to find the “saboteur,” and Review adviser Jeffrey Hart releases a written response that attacks Freedman for falsely accusing the Review of racism (see March 15, 1982, 1983, and August 2002) and intolerance (see 1981, 1984, 1985, and July 1990). (Hohler 10/5/1990; Waligore 9/20/2006) Days later, Simon publishes an editorial in the New York Times decrying the Review’s reference to Hitler, but calling the publication of the quote “sabotage” and saying: “[s]omeone secretly gained access to the production process.… Since the slur was deviously implanted in a section that remains unchanged from week to week, the subterfuge eluded the proofreaders.” He describes Pritchett as “horrified” by the incident, says that any accusations of anti-Semitism on the Review’s part are “preposterous,” and accuses Freedman of orchestrating a protest against the Review “that quickly metamorphosed into an instrument of hate—hate directed against student journalists who, as a result, suffered death warnings, threats of violence, as well as mean-spirited accusations.” The Review serves to “question, challenge, and even deride the dominant liberal orthodoxy on the campus, exposing its hypocrisies,” Simon writes, and calls any attempt to call the Review to account “political opportunism.” (Simon 10/20/1990)
Investigation Finds Quote Included by Staff, Editors - The ADL will indeed conduct an investigation, and will find that the Hitler quote was from a well-thumbed book in the Review’s office. It will conclude that a Review staffer had inserted the quote with the knowledge and apparent complicity of the senior editors. The ADL will call the publication of the quote “obviously an anti-Semitic act,” and write, “Prior acts of the Review and the past conduct of its members have contributed, the commission believes, to the creation of an environment which condoned and even encouraged a member of the Review to include the offensive Hitler quote.” The investigation notes that the Review has frequently published other offensive comments such as “the only good Indian is a dead Indian” and “genocide means never having to say you’re sorry.”
History of Anti-Semitism - The Review has a history of anti-Semitic publishings (see October 1982 and November 9-10, 1988). D’Souza says Review trustees have repudiated such actions, which he calls the work of unpolished and overzealous staffers who sometimes run the Review like “a half-baked, ramshackle student paper.”
Review President, Contributors Resign over Furor - C. Tyler White, president of the Review, will soon resign in protest. “I cannot allow the Review to ruin my life any further,” he will write. “The official Review response, which I co-signed and helped distribute, avoids the main thrust of the issue. It does not emphasize our sorrow in this dreadful act of malice, nor does it claim responsibility for letting it reach newsprint.… The editor in chief has failed in his job, and now we must wear the albatross of anti-Semitism because he won’t take responsibility for the issue’s contents.” Review contributors David Budd and Pang-Chun Chen resign along with White, writing, “We are conservatives, but we are not Nazis.” Budd writes that the Review’s apology implied “let’s put the blame on someone else.”
Congressional Involvement - US Representative Chester Atkins (D-MA) delivers a letter concerning the incident to Freedman, accusing the Review of “fomenting hatred and intolerance.” The letter is signed by 84 of Atkins’s fellow Congress members. Atkins is running for re-election against a Review board member, John MacGovern. Atkins says MacGovern should step down as a board member; MacGovern refuses, saying the Review’s senior editors are not responsible for the Hitler quote. (Hohler 10/5/1990; Waligore 9/20/2006)
George Loeb, a minister in the virulently racist Church of the Creator (COTC—see 1973 and 1982-1983), writes a letter to the editor of the Fort Pierce Tribune. Loeb writes in part: “To you, your readers, and all of chose quoted [in a Tribune article], let me just say this_WAKE UP! There is no need to judge each individual n_gger. We do not have the time.… It is your obvious intention to reinforce the mistaken impressions of the ignorant. This is to the detriment of the besieged white community. It is also why we publish and distribute ‘Racial Loyalty’ [the COTC monthly newsletter]: to offset the deliberate lies and distortions of the jewish [sic] media and to motivate White people to clean up this mess themselves since they cannot count on you, your paper, or your police for any help.” Around the same time, Loeb tells a reporter: “The only thing they [blacks] can do is get in my face, and that’s a mistake.… If my back’s against the wall, I won’t run. I have to do what I have to do.” (Anti-Defamation League 1993; Anti-Defamation League 7/6/1999) Two months later, Loeb will murder an African-American man in a Florida parking lot (see June 6, 1991 and After).
George Loeb, a minister for the white supremacist Church of the Creator (COTC—see 1973 and 1982-1983), is arrested and charged with murdering African-American Gulf War veteran Harold Mansfield Jr. in a Neptune, Florida, parking lot two weeks ago.
Confrontation and Murder - Loeb nearly sideswept Mansfield’s car in the parking lot of a local shopping center, and Mansfield honked his horn at Loeb. The two argued before Mansfield drove away. Loeb then drove to a convenience store, where he bought two six-packs of beer, gave the cashier a card reading “White People Awaken. Save the White Race,” and, according to the cashier, angrily shouted racist epithets and statements while in the store. Meanwhile, Mansfield and a friend returned to the parking lot to confront Loeb. The two resumed their argument. (Anti-Defamation League 1993; Anti-Defamation League 7/6/1999; Southern Poverty Law Center 9/1999) According to witnesses, Loeb provoked Mansfield with racial taunts and epithets. (Smothers 5/19/2006) Mansfield brandished a brick, and Loeb pulled out a .25-caliber semiautomatic handgun. Mansfield attempted to retreat, but Loeb shot him in the chest. Loeb then fired at Mansfield’s friend, who fled to the grocery store to escape Loeb and call for help. By the time the friend returned to the car, Mansfield was almost dead. He died shortly thereafter.
Previous Arrests for Racially Motivated Altercations - After Loeb’s arrest, the press learns of a previous arrest in November 1990, when Loeb followed an African-American woman and her daughter, called the woman a racial slur, and threatened to shoot her. In January 1991, Loeb was arrested again for starting a fistfight with an African-American neighbor; he was charged with disorderly intoxication and resisting arrest. In April 1991, Loeb wrote a letter to the Fort Pierce Tribune stating his racist views (see April 1991). When they arrest him for Mansfield’s murder, police seize over 1,600 pages of personal correspondence and racist propaganda from Loeb’s apartment, including a document written to a Ku Klux Klan member that reads in part: “The frequent use of the word n_gger should lead to a widespread and violent black uprising that should give whites (and possibly police) the opportunity to kill large numbers of them with impunity. It is our feeling as Creators [COTC members] that shrinking the numbers of blacks worldwide is one of the highest priorities.”
Arrest in New York - Loeb and his wife Barbara left their Neptune condominium and fled Florida within hours of the shooting, assisted by fellow COTC member Steve Gabott Thomas. (Thomas is one of four Army soldiers convicted of raping and murdering a Vietnamese woman in 1966, a crime that formed the basis of the 1989 film Casualties of War. He served four years of a life sentence before being released on parole.) On June 6, 1991, the couple is arrested in Poughkeepsie, New York, after George Loeb assaults a grocery store security guard who caught him trying to steal a package of sandwich meat. Officers search their car and find two smoke bombs, a .22-caliber rifle with a scope and extra magazines, a 12-gauge shotgun, and approximately 1,000 rounds of assorted ammunition. Additionally, Barbara Loeb’s purse contains a handgun and ammunition.
Convictions - Barbara Loeb is arrested for weapons possession, and later sentenced to a year in prison. George Loeb is charged with murder and extradited to Florida. Loeb will claim that he killed Mansfield in self-defense, and will tell the jury that he contemplated fleeing to Canada because it is a “predominantly white country” where he might expect to be treated more impartially. He will be found guilty of first-degree murder and sentenced to 25 years without parole. Loeb will attempt to kill himself in the hours after his conviction; he will tell police, “I want to die because the whole world is an _sshole.” Thomas will be convicted of being an accessory after the fact to the murder and sentenced to a year’s probation, likely because he helped police in capturing the Loebs.
Martyrdom - COTC members will attempt to portray Loeb as a hero and martyr, claiming that he killed Mansfield in self-defense and is a hero of white people everywhere. However, COTC leader Ben Klassen will not publicly endorse the murder, telling a reporter: “I am no more responsible for [the murder] than the pope is responsible for all the Catholic felons in prison.… Not at all.” Klassen will also tell the reporter that Thomas, who aided the Loebs’ flight, will no longer be a COTC member. Radio personality Rush Limbaugh hosts his own late-night television show; Roger Ailes, the Republican campaign consultant (see 1968, January 25, 1988, and September 21 - October 4, 1988), is his executive producer. On this show, Limbaugh gives his response to African-American filmmaker Spike Lee’s recommendation that African-American children be allowed to skip school to watch his biographical docudrama Malcolm X: “Spike, if you’re going to do that, let’s complete the education experience. You should tell them that they should loot the theater and then blow it up on their way out.” (Media Matters 10/27/2009) Ailes will go on to found Fox News (see October 7, 1996).
White supremacist Timothy McVeigh (see March 24, 1988 - Late 1990 and November 1991 - Summer 1992) moves out of his father’s house in Pendleton, New York, and into a nearby apartment. During this time, he may have a brief affair with a married woman. Also, sometime during this period, he obtains a Ku Klux Klan membership card in Harrison, Arkansas, and drives to Michigan, where he meets his friend Terry Nichols’s brother James Nichols (see December 22 or 23, 1988). He begins receiving subscription copies of the white supremacist magazine The Spotlight. (PBS Frontline 1/22/1996)
Richard “Rick” McCarty, the new leader of the Church of the Creator (COTC—see 1973 and Early 1992 - January 1993), moves the COTC headquarters to Niceville, Florida. McCarty is a professional telemarketer with almost no visibility within the COTC or the larger white supremacist movement. He has a criminal record for running a telemarketing scam in Birmingham, Alabama. He begins his tenure by touting a March 1993 appearance on a television talk show hosted by Sally Jessy Raphael, along with three fellow white supremacists and a small group of black separatists; the two sides engage in angry rhetoric, but little else. In August 1993, McCarty tells a local reporter: “People are finally waking up to the fact that the white man is going to have no country of his own. We don’t have nothing against anybody. We just want to repatriate the blacks and Jews back to their countries of origin.” Reporting McCarty’s words, the Palm Beach Post also states that the COTC has no temple or compound in Niceville, “but it does have a warehouse that holds $500,000 in white supremacist pamphlets, newspapers, and books. They are distributed in all 50 states, and 37 foreign countries, McCarty said.” (Southern Poverty Law Center 9/1999)
The Bureau of Alcohol, Tobacco, and Firearms (BATF) asks the Army for assistance in raiding the Branch Davidian compound near Waco, Texas (see November 1992 - January 1993 and 5:00 A.M. - 9:30 A.M. February 28, 1993). The request is not acknowledged by federal or military officials for over six years. Army officials will note that such involvement is illegal unless the president personally makes the request; they say that no such request was ever considered. In 1999, the General Accounting Office (GAO) will find that military personnel were called to the scene after the BATF “cited possible drug-related activity” at the Davidian compound. The BATF makes the request through Operation Alliance, an agency that coordinates law enforcement requests for military help in fighting drugs. The BATF requests training by special forces troops, instruction in driving Bradley Fighting Vehicles (BFVs), and the loan of seven BFVs. Operation Alliance will forward the request to Fort Bliss, the home of Joint Task Force 6 (JTF-6), the military’s headquarters for domestic anti-drug efforts. JTF-6 officials are told that the requested assistance is “in direct support of interdiction activities along the Southwest border.” However, Major Mark Petree, the commander of the Army’s special forces, questions the legality of the request. His legal adviser, Major Phillip Lindley, writes a memo stating that the BATF request would make the military an active, illegal partner in a domestic police action. JTF-6 officers accuse Lindley of trying to undermine the mission, and Lindley refers the matter to Lieutenant Colonel Douglas Andrews, the deputy staff judge advocate. Andrews says that the military could probably evaluate the BATF plan of attack (see February 24-27, 1993), but cannot intervene to cancel or revise it. (House Committee on Government Reform and Oversight 8/2/1996; Associated Press 10/31/1999) In 1996, a Congressional investigation will find that the BATF deliberately misrepresented the Davidians as a drug cartel in order to receive military assistance and avoid reimbursing the military for that assistance (see August 2, 1996). A Houston psychiatrist who has interviewed the children released from the besieged Branch Davidian compound near Waco, Texas (see 5:00 A.M. - 9:30 A.M. February 28, 1993 and March 1, 1993), reports that some of the children have drawn pictures of the compound being consumed by flames. Other children have told him that “everyone is going to die” in the compound, that Davidian leader David Koresh intends “to blow you all up,” and when the children left the compound, their parents promised to “see them in heaven.” The children’s statements and drawings are another indication of a violent end to the siege, with the possibility of a mass suicide (see April 19, 1993). White separatist Timothy McVeigh (see March 24, 1988 - Late 1990 and November 1991 - Summer 1992) meets white supremacist Andreas Strassmeir (see 1973 and After) at a gun show in Tulsa, Oklahoma (see January 23, 1993 - Early 1994). Strassmeir is the chief of security at Elohim City, a white supremacist compound in eastern Oklahoma. McVeigh will go on to blow up a federal building in Oklahoma City (see 8:35 a.m. - 9:02 a.m. April 19, 1995); a precursor of the McVeigh-Nichols bomb plot was hatched in 1983 by Elohim City residents (see 1983). McVeigh will make at least two visits to Elohim City before carrying out the bombing (see October 12, 1993 - January 1994 and September 12, 1994 and After), though federal investigators will rule out any involvement by Strassmeir or any other Elohim City residents in the bombing plot (see August 1994 - March 1995).
