The Defense Department’s office of the inspector general issues a report saying allegations made by members of the Able Danger program are unfounded. According to the inspector general, Able Danger did not identify any of the 9/11 hijackers before the attacks, the program’s members were not prevented from sharing this information with the FBI, and there was no retaliation against one person involved in the program, Lieutenant Colonel Anthony Schaffer, after he highlighted the issue in the media. The basis for the main claim that the hijackers were not identified before 9/11 is that the recollections of the people who claim lead hijacker Mohamed Atta was identified “varied significantly.” In addition, the names of Atta and the other 9/11 hijackers said to have been identified by the program were not present in any surviving documentation, although the vast majority of the data gathered by the Able Danger program was destroyed several years ago (see May-June 2000). Concerning the blocking of passage of information to the FBI, the inspector general identified only one occasion when this may have happened, but found that such blocking “would not have been inappropriate under the circumstances.” [Department of Defense Office of the Inspector General, 9/18/2006 ]
The ranking members of the House Government Reform Committee and the Committee on Science, Energy, and Commerce ask the Government Accountability Office to investigate the impact that Bush’s proposed budget cuts (see Early February 2006) and the EPA library closures (see, e.g., August 15, 2006 and October 20, 2006 and After) will have on scientific research, regulatory quality, and enforcement capability. The letter cites the concerns of EPA scientists that the changes will “harm the agency’s ability to carry out its mission and will be especially damaging to EPA’s ability to enforce environmental laws.” It adds that EPA employees fear the library reorganization scheme may result in the “permanent” loss of access to many documents. President Bush signs the 2007 Defense Authorization Act into law. The bill contains a provision that allows the president to more easily declare “martial law” in the US. If Bush or a successor does so, the bill gives the administration the ability to strip much of state governors’ powers over their National Guards and relegate that authority to the federal government. Congress is likely to challenge that provision in the future. The bill makes significant changes to the Insurrection Act that allows the president to invoke the Act during events such as natural disasters, and thereby suspend the 1878 Posse Comitatus Act that prevents the US military from acting in a law enforcement capacity. Senator Patrick Leahy (D-VT) says, “[W]e certainly do not need to make it easier for Presidents to declare martial law. Invoking the Insurrection Act and using the military for law enforcement activities goes against some of the central tenets of our democracy.” [US Senate, 9/19/2006] The relevant section of the bill is entitled “Use of the Armed Forces in Major Public Emergencies.” This section states that “the President may employ the armed forces, including the National Guard in Federal service, to restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of… maintaining public order, in order to suppress, in any State, any insurrection, domestic violence, unlawful combination, or conspiracy.” [US Congress, 9/19/2006] GlobalResearch’s Frank Morales will write that the new law allows the federal government to, if it chooses, “commandeer guardsmen from any state, over the objections of local governmental, military, and local police entities; ship them off to another state; conscript them in a law enforcement mode; and set them loose against ‘disorderly’ citizenry….” Under the new law, the federal government may more easily order National Guard troops to round up and detain protesters, illegal aliens, “potential terrorists,” and just about anyone else, and ship them off to detention facilities. Those facilities were contracted out for construction to KBR, a subsidiary of Halliburton, in January 2006, according to the Journal of Counterterrorism and Homeland Security International, at a cost of $385 million over five years. The Journal noted that “the contract is to be executed by the US Army Corps of Engineers… for establishing temporary detention and processing capabilities to augment existing [immigration] Detention and Removal Operations (DRO)—in the event of an emergency influx of immigrants into the US, or to support the rapid development of new programs.” [GlobalResearch (.ca), 10/29/2006] Virtually no Congressional lawmakers seriously objected to the bill’s provision during debate. One of the few exceptions is Leahy, who will, six weeks later, sharply criticize the provision during debate over a separate piece of legislation. Leahy will say, “Using the military for law enforcement goes against one of the founding tenets of our democracy, and it is for that reason that the Insurrection Act has only been invoked on three—three—[occasions] in recent history. The implications of changing the Act are enormous, but this change was just slipped in the defense bill as a rider with little study. Other congressional committees with jurisdiction over these matters had no chance to comment, let alone hold hearings on, these proposals.… This is a terrible blow against rational defense policy-making and against the fabric of our democracy. Since hearing word a couple of weeks ago that this outcome was likely, I have wondered how Congress could have gotten to this point.… [I]t seems the changes to the Insurrection Act have survived… because the Pentagon and the White House want it.… Because of this rubberstamp Congress,… [w]e fail the National Guard, which expects great things from us as much as we expect great things from them. And we fail our Constitution, neglecting the rights of the States, when we make it easier for the president to declare martial law and trample on local and state sovereignty.” [US Senate, 10/29/2006]

The EPA publishes a notice in the Federal Register that it will be closing its headquarter library on October 1. The library contains 380,000 documents on microfiche, a microforms collection of abstracts and indexes, 5,500 hard copy agency documents, and more than 16,000 books and technical reports produced by other government agencies. The EPA has already quietly closed several regional libraries, whose collections are currently not available to anyone, even the agency’s own scientists (see August 15, 2006). Though agency officials insist that the collections from these libraries will be digitized and made available via the Internet, no funds have yet been allocated for this purpose. [PEER, 8/21/2006; Environmental Protection Agency, 9/20/2006 ] Unlike today’s notice about the closing of the headquarter library, no public notice was given for the closures of the agency’s regional libraries (see August 15, 2006).
Senator Barack Obama (D-IL) speaks out against the Military Commissions Act (MCA), which gives the federal government wide latitude to incarcerate and interrogate “terror suspects” without charge or due process of the law (see October 17, 2006). Obama says that “political considerations” for the upcoming midterm elections played a significant role in the timing of the bill, but “what we’re doing here today—a debate over the fundamental human rights of the accused—should be bigger than politics. This is serious. If this was a debate with obvious ideological differences—heartfelt convictions that couldn’t be settled by compromise—I would understand. But it’s not.” Obama notes that in five years of the Bush administration’s system of military tribunals, “not one terrorist has been tried. Not one has been convicted. And in the end, the Supreme Court of the United States found the whole thing unconstitutional (see June 30, 2006), which is why we’re here today. We could have fixed all of this in a way that allows us to detain and interrogate and try suspected terrorists while still protecting the accidentally accused from spending their lives locked away in Guantanamo Bay. Easily. This was not an either-or question.” Congress could have written and passed legislation that would have established “a real military system of justice that would sort out the suspected terrorists from the accidentally accused,” one that would be in line with domestic law and the Geneva Conventions. Instead, “politics won today.… The administration got its vote, and now it will have its victory lap, and now they will be able to go out on the campaign trail and tell the American people that they were the ones who were tough on the terrorists.” Meanwhile, Obama says, questions about the efficacy and legality of the Bush system of justice persist, al-Qaeda and the Taliban are regrouping “while we look the other way,” and the administration is bent on fighting a war in Iraq “that our own government’s intelligence says is serving as al-Qaeda’s best recruitment tool.… This is not how a serious administration would approach the problem of terrorism.” [US Senate, 9/28/2006]
The newly passed Military Commissions Act (MCA—see October 17, 2006) gives the executive branch sweeping new powers sought by President Bush and Vice President Cheney since the 9/11 attacks, according to a New York Times analysis. Reporters Scott Shane and Adam Liptak write, “Rather than reining in the formidable presidential powers Mr. Bush and Vice President Dick Cheney have asserted since Sept. 11, 2001, the law gives some of those powers a solid statutory foundation. In effect it allows the president to identify enemies, imprison them indefinitely, and interrogate them—albeit with a ban on the harshest treatment—beyond the reach of the full court reviews traditionally afforded criminal defendants and ordinary prisoners. Taken as a whole, the law will give the president more power over terrorism suspects than he had before the Supreme Court decision this summer in Hamdan v. Rumsfeld that undercut more than four years of White House policy” (see June 30, 2006). The MCA “does not just allow the president to determine the meaning and application of the Geneva Conventions; it also strips the courts of jurisdiction to hear challenges to his interpretation.” Additionally, it gives Bush and his designees the absolute, unchallenged power to define anyone they choose as an “enemy combatant,” thereby stripping them of any traditional US legal protections and placing them under the far harsher and restrictive rubric of the MCA. “Over all, the legislation reallocates power among the three branches of government, taking authority away from the judiciary and handing it to the president.” Law professor Bruce Ackerman notes, “The president walked away with a lot more than most people thought. [The MCA] further entrenches presidential power” and allows the administration to declare even an American citizen an unlawful combatant subject to indefinite detention. “And it’s not only about these prisoners,” says Ackerman. “If Congress can strip courts of jurisdiction over cases because it fears their outcome, judicial independence is threatened.” [New York Times, 9/30/2006]
Congress rewrites a two-centuries-old prohibition against the president using federal troops, or state National Guard troops acting under federal control, to act as police on domestic soil. The prohibition dates back to the Insurrection Act of 1807, which stated that the only circumstance under which the president could use troops to enforce the law against US citizens is during a time of armed revolt. The ban on using troops against citizens was strengthened by the 1878 Posse Comitatus Act, which forbids any government official from using military soldiers as police without specific authorization from Congress. The new law stems from the reported lawlessness that swept New Orleans after Hurricane Katrina devastated large parts of the city. The governor of Louisiana, Democrat Kathleen Blanco, refused to allow the federal government to take over the evacuation of the city, fearing that the change would amount to martial law (see 11:00 am EDT August 25, 2005). After this rejection, and the devastation wrought in Texas by Hurricane Rita just weeks later, President Bush began discussing the idea of a new law that would allow the president to impose martial law in a region for reasons other than citizen uprisings. He called it “making the Department of Defense the lead agency” in handling emergencies such as those created by Katrina and Rita, or by another terrorist attack on the scale of 9/11. (Former Justice Department lawyer John Yoo argues that the president does not need any new laws because his inherent authority as commander in chief lets him send federal troops anywhere he likes, no matter what the law says.) A year later, Congressional Republicans slip a provision into a large military appropriations bill allowing the president to deploy federal troops as police at his discretion, regardless of the possible objections of state governors. Any situation in which the president feels the “constituted authorities of the State or possession are incapable of maintaining public order” can trigger military control of a city, county, or state at the president’s behest. Bush signs the law into effect on October 17 with virtually no debate or public discussion. [Savage, 2007, pp. 316-319]
Federal prosecutors attempt to determine just how much corruption, fraud, and theft has occurred among government contracts handed out to corporations for their work in Iraq. The preliminary answer: a great deal. The US Justice Department chooses to center its probe into war profiteering in the small town of Rock Island, Illinois, because high-ranking Army officials at the arsenal there administer KBR’s LOGCAP III contract to feed, shelter, and support US soldiers, and to rebuild Iraq’s oil infrastructure. KBR, formerly Kellogg, Brown, & Root, is a subsidiary of oil-construction giant Halliburton. The reported violations are rampant (see February 20, 2008, October 2005, October 2002, April 2003, June 2003, and September 21, 2007). [Chicago Tribune, 2/20/2008] The investigation is under the aegis of the National Procurement Fraud Task Force, formed by the Justice Department to detect, identify, prevent, and prosecute procurement fraud by firms such as KBR. The Task Force includes the FBI, the US Inspectors General community, the Executive Office for United States Attorneys, and others. [PR Newswire, 7/13/2007]
Multiple Prosecutions Underway - The Justice Department prosecutes four former supervisors for KBR, the large defense firm responsible for most of the military logistics and troop supply operations in Iraq. The government also prosecutes five executives from KBR subcontractors; an Army officer, Pete Peleti, has been found guilty of taking bribes (see February 20, 2008). Two KBR employees have already pleaded guilty in another trial, and about twenty more people face charges in the ever-widening corruption scandal. According to recently unsealed court documents, kickbacks, corruption, and fraud were rampant in contractual dealings months before the first US combat soldier arrived in Iraq. Not only did KBR contractors receive handsome, and illicit, payoffs, but the corruption and fraud endangered the health and safety of US troops stationed in Iraq and Kuwait. One freight-shipping subcontractor has already confessed to bribing five KBR employees to receive preferential treatment; five more were named by Peleti as accepting bribes. Prosecutors have identified three senior KBR executives as having approved deliberately inflated bids. None of these people have yet been charged. Other related charges have been made, from KBR’s refusal to protect employees sexually assaulted by co-workers to findings that the corporation charged $45 for a can of soda.
Pentagon Slashed Oversight - The overarching reason why such rampant fraud was, and is, taking place, prosecutors and observers believe, is that the Department of Defense outsourced critical troop support jobs while simultaneously slashing the amount of government oversight (see 2003 and Beyond).
Lack of Cooperation - Kuwait refuses to extradite two Middle Eastern businessmen accused of LOGCAP fraud. And KBR refuses to provide some internal documents detailing some of its managers’ business dealings. KBR says it “has not undertaken an exhaustive search of its millions of pages of procurement documents” to determine whether other problems exist. Congress, stung into action by the Bush administration’s poor response to Hurricane Katrina and particularly the ineptitude of Michael Brown, the former director of the Federal Emergency Management Agency (FEMA—see Early September 2001), passes a law saying that President Bush must nominate a replacement who has “a demonstrated ability in and knowledge of emergency management,” and “not less than five years of executive leadership.” In a signing statement, Bush says that only he, the head of the executive branch, can decide who to appoint to offices. Therefore, he states, he is ignoring the prohibition. [Savage, 2007, pp. 239-240]
Citing proposed cuts in its 2007 fiscal year budget, the EPA begins ordering its regional offices to cancel subscriptions to several of the technical journals and environmental publications that are used by its scientists. One internal email reveals that the agency’s Mid-Atlantic Region is being asked “to cut its journal renewals about in half.” According to the organization Public Employees for Environmental Responsibility (PEER), the subscription cancellations mean that “agency scientists and other technical specialists will no longer have ready access to materials that keep them abreast of developments within their fields. Moreover, enforcement staff, investigators, and other professionals will have a harder time tracking new developments affecting their cases and projects.” The cancellations come on top of the closures of several EPA libraries that have already cut employees’ access off from tens of thousands of documents (see, e.g., September 20, 2006 and August 15, 2006). When news of the library closures sparked protest from EPA scientists over the summer (see June 29, 2006), agency officials attempted to assuage their concerns with promises that the EPA would implement a “new library plan to make environmental information more accessible to employees.” But critics say the subscription cancellations contradict this claim and are a clear sign that the agency does not intend to improve its staff’s access to the information. NBC Nightly News reports: “Investigators tell NBC News that the water used to make [the anthrax spores] came from a northeastern US, not a foreign, source. Traces of chemicals found inside the spores revealed the materials used to grow them. And scientists have also mapped the entire DNA chain of the anthrax hoping to narrow down the laboratories where it came from. But one possible clue evaporated. The FBI concluded the spores were not coated with any chemical to make them hang longer in the air.” [MSNBC, 10/5/2006] Later in the year, Rutgers University microbiologist Richard Ebright says, “This information [about the water], if correct, would appear to narrow the field” of laboratories that the anthrax used in the 2001 anthrax attacks (see October 5-November 21, 2001) could have come from. Ebright knows of only three labs in the Northeast US that had seed cultures of the Ames strain prior to the attacks:

The US commander for Europe, General James Jones, confirms that he made a damning quote to author Bob Woodward. In Woodward’s September, 2006 book State of Denial, Jones is quoted as saying that Defense Secretary Donald Rumsfeld had “systematically emasculated” the military’s leadership. Jones confirms to a Washington Post reporter that he indeed said those words to Woodward. According to the book, Jones, formerly the Marine Chief of Staff, called the war in Iraq a “debacle,” and added, “The Joint Chiefs have been systematically emasculated by Rumsfeld.” According to the book, Jones also told Marine General Peter Pace, who was about to become the chairman of the Joint Chiefs, “You should not be the parrot on the secretary’s shoulder.” Pace has denied that Jones made such a remark to him. Jones says that the quotes are correct—though he now says Iraq is less of a “debacle” than a “big problem”—but adds, “[H]ad I seen [the book], I probably would have suggested that the tone was more critical than I intended it to be.” Jones says: “I do not associate myself with the so-called revolt of the generals. I believe that general officers, both active and retired, have an obligation to let their views be known,” but should do so in a “helpful” way. Of his comments about Rumsfeld, he says, “We’re a team, we’re together, we have occasional family disagreements.” [Washington Post, 10/5/2006; Roberts, 2008, pp. 158, 247]
In two separate sessions, from October 6-11 and again from December 4-14, officials of the International Committee of the Red Cross (ICRC) interview 14 detainees newly transferred from a variety of CIA secret “black sites” to Guantanamo. The transfers followed President Bush’s acknowledgment that the CIA has maintained a number of these sites and his announced intention to have a number of the detainees sent to the Cuban facility (see September 17, 2001 and September 6, 2006).
ICRC Access - The ICRC is legally bound to monitor compliance with the Geneva Conventions and to supervise the treatment of prisoners of war; previously, it had not been allowed to see the detainees, and in some cases were never informed of their detention. The ICRC officials interview each prisoner in private, with the intention of producing “a description of the treatment and material conditions of detention of the 14 during the period they were held in the CIA detention program.”
Interviews - The 14 have been held for periods ranging “from 16 months to almost four and a half years.” The ICRC’s report, never intended for public consumption, will be released to the CIA several months later (see February 14, 2007) and revealed in a book in early 2009 (see March 15, 2009). Some of the detainees, concerned about the possible repercussions that may ensue from their discussions, ask the ICRC to withhold their names from some allegations, though most of the report attributes specific narratives and allegations to particular prisoners. Almost every allegation is independently corroborated by other, named detainees.
'Striking Similarity' - In 2009, author Mark Danner will write, quoting the ICRC report: “[I]ndeed, since the detainees were kept ‘in continuous solitary confinement and incommunicado detention’ throughout their time in ‘the black sites,’ and were kept strictly separated as well when they reached Guantanamo, the striking similarity in their stories, even down to small details, would seem to make fabrication extremely unlikely, if not impossible. ‘The ICRC wishes to underscore,’ as the writers tell us in the introduction, ‘that the consistency of the detailed allegations provided separately by each of the 14 adds particular weight to the information provided below.’”

Conclusion - The report concludes: “The allegations of ill-treatment of the detainees indicate that, in many cases, the ill-treatment to which they were subjected while held in the CIA program, either singly or in combination, constituted torture. In addition, many other elements of the ill-treatment, either singly or in combination, constituted cruel, inhuman, or degrading treatment.” Danner will write, “Such unflinching clarity, from the body legally charged with overseeing compliance with the Geneva Conventions—in which the terms ‘torture’ and ‘cruel, inhuman, and degrading treatment’ are accorded a strictly defined legal meaning—couldn’t be more significant.” [New York Review of Books, 3/15/2009]

[White House, 10/17/2006] The MCA is designed to give the president the authority to order “enemy detainees” tried by military commissions largely outside the scope of US civil and criminal procedures. The bill was requested by the Bush administration after the Supreme Court’s ruling in Hamdi v. Rumsfeld (see June 28, 2004) that the US could not hold prisoners indefinitely without access to the US judicial system, and that the administration’s proposal that they be tried by military tribunals was unconstitutional (see June 28, 2004). [FindLaw, 10/9/2006] It is widely reported that the MCA does not directly apply to US citizens, but to only non-citizens defined as “enemy combatants. [CBS News, 10/19/2006] However, six months later, a Bush administration lawyer will confirm that the administration believes the law does indeed apply to US citizens (see February 1, 2007).
Sweeping New Executive Powers - The MCA virtually eliminates the possibility that the Supreme Court can ever again act as a check on a president’s power in the war on terrorism. Similarly, the law gives Congressional approval to many of the executive powers previously, and unilaterally, seized by the Bush administration. Former Justice Department official John Yoo celebrates the MCA, writing, “Congress… told the courts, in effect, to get out of the war on terror” (see October 19, 2006). [Savage, 2007, pp. 319, 322]
'Abandoning' Core 'Principles' - The bill passed the Senate on a 65-34 vote, and the House by a 250-170 vote. The floor debate was often impassioned and highly partisan; House Majority Leader John Boehner (R-OH) called Democrats who opposed the bill “dangerous,” and Senate Judiciary Committee member Patrick Leahy (D-VT) said this bill showed that the US is losing its “moral compass.” Leahy asked during the debate, “Why would we allow the terrorists to win by doing to ourselves what they could never do, and abandon the principles for which so many Americans today and through our history have fought and sacrificed?” Senate Judiciary Committee chairman Arlen Specter (R-PA) had said he would vote against it because it is “patently unconstitutional on its face,” but then voted for it, saying he believes the courts will eventually “clean it up.” Specter’s attempt to amend the bill to provide habeas corpus rights for enemy combatants was defeated, as were four Democratic amendments. Republicans have openly used the debate over the MCA as election-year fodder, with House Speaker Dennis Hastert (R-IL) saying after the vote that “House Democrats have voted to protect the rights of terrorists,” and Boehner decrying “the Democrats’ irrational opposition to strong national security policies.” Democrats such as Senator Barack Obama (D-IL) say they will not fight back at such a level. “There will be 30-second attack ads and negative mail pieces, and we will be called everything from cut-and-run quitters to Defeatocrats, to people who care more about the rights of terrorists than the protection of Americans,” Obama says. “While I know all of this, I’m still disappointed, and I’m still ashamed, because what we’re doing here today—a debate over the fundamental human rights of the accused—should be bigger than politics.” [Washington Post, 10/19/2006] After winning the vote, Hastert accused Democrats who opposed the bill of “putting their liberal agenda ahead of the security of America.” Hastert said the Democrats “would gingerly pamper the terrorists who plan to destroy innocent Americans’ lives” and create “new rights for terrorists.” [New York Times, 10/19/2006]
Enemy Combatants - The MCA applies only to “enemy combatants.” Specifically, the law defines an “unlawful enemy combatant” as a person “who has engaged in hostilities or who has purposefully and materially supported hostilities against the United States or its co-belligerents,” and who is not a lawful combatant. Joanne Mariner of Human Rights Watch says the definition far exceeds the traditionally accepted definition of combatant as someone who directly participates in hostilities. But under the MCA, someone who provides “material support” for terrorists—whether that be in the form of financial contributions or sweeping the floors at a terrorist camp—can be so defined. Worse, the label can be applied without recourse by either Bush or the secretary of defense, after a “competent tribunal” makes the determination. The MCA provides no guidelines as to what criteria these tribunals should use. Taken literally, the MCA gives virtually unrestricted power to the tribunals to apply the label as requested by the president or the secretary. Mariner believes the definition is both “blatantly unconstitutional” and a direct contradiction of centuries of Supreme Court decisions that define basic judicial rights. [FindLaw, 10/9/2006] Under this definition, the president can imprison, without charge or trial, any US citizen accused of donating money to a Middle East charity that the government believes is linked to terrorist activity. Citizens associated with “fringe” groups such as the left-wing Black Panthers or right-wing militias can be incarcerated without trial or charge. Citizens accused of helping domestic terrorists can be so imprisoned. Law professor Bruce Ackerman calls the MCA “a massive Congressional expansion of the class of enemy combatants,” and warns that the law may “haunt all of us on the morning after the next terrorist attack” by enabling a round of mass detentions similar to the roundup of Japanese-American citizens during World War II. [Savage, 2007, pp. 322]
Military Commissions - The MCA mandates that enemy combatants are to be tried by military commissions, labeled “regularly constituted courts that afford all the necessary ‘judicial guarantees which are recognized as indispensable by civilized peoples’ for purposes of common Article 3 of the Geneva Conventions.” The commissions must have a minimum of five commissioned military officers and a military judge; if death is a possible penalty, the commissions must have at least 12 officers. The defendant’s guilt must be proven beyond a reasonable doubt; convictions require a two-thirds vote. Sentences of beyond 10 years require a three-quarters vote, and death penalties must be unanimously voted for. Defendants may either represent themselves or by military or civilian counsel. The court procedures themselves, although based on standard courts-martial proceedings, are fluid, and can be set or changed as the secretary of defense sees fit. Statements obtained through methods defined as torture are inadmissible, but statements take by coercion and “cruel treatment” can be admitted. The MCA sets the passage of the Detainee Treatment Act (DTA—see December 15, 2005) as a benchmark—statements obtained before the December 30, 2005 enactment of that law can be used, even if the defendant was “coerced,” if a judge finds the statement “reasonable and possessing sufficient probative value.” Statements after that date must have been taken during interrogations that fall under the DTA guidelines. Defendants have the right to examine and respond to evidence seen by the commission, a provision originally opposed by the administration. However, if the evidence is classified, an unclassified summary of that material is acceptable, and classified exculpatory evidence can be denied in lieu of what the MCA calls “acceptable substitutes.” Hearsay evidence is admissible, as is evidence obtained without search warrants. Generally, defendants will not be allowed to inquire into the classified “sources, methods, or activities” surrounding evidence against them. Some human rights activists worry that evidence obtained through torture can be admitted, and the fact that it was obtained by torture, if that detail is classified, will not be presented to the court or preclude the evidence from being used. Public access to the commissions will be quite limited. Many experts claim these commissions are illegal both by US constitutional law and international law. [FindLaw, 10/9/2006]
Secret Courts - The military tribunals can be partially or completely closed to public scrutiny if the presiding judge deems such an action necessary to national security. The government can convey such concerns to the judge without the knowledge of the defense. The judge can exclude the accused from the trial if he deems it necessary for safety or if he decides the defendant is “disruptive.” Evidence can be presented in secret, without the knowledge of the defense and without giving the defense a chance to examine that evidence, if the judge finds that evidence “reliable.” And during the trial, the prosecution can at any time assert a “national security privilege” that would stop “the examination of any witness” if that witness shows signs of discussing sensitive security matters. This provision can easily be used to exclude any potential defense witness who might “breach national security” with their testimony. Author and investigative reporter Robert Parry writes, “In effect, what the new law appears to do is to create a parallel ‘star chamber’ system for the prosecution, imprisonment, and elimination of enemies of the state, whether those enemies are foreign or domestic.” [Consortium News, 10/19/2006]
Appeals - Guilty verdicts are automatically appealed to a Court of Military Commission Review, consisting of three appellate military justices. The DC Circuit Court of Appeals has extremely limited authority of review of the commissions; even its authority to judge whether a decision is consistent with the Constitution is limited “to the extent [that the Constitution is] applicable.”
Types of Crimes - Twenty-eight specific crimes fall under the rubric of the military commissions, including conspiracy (not a traditional war crime), murder of protected persons, murder in violation of the bill of war, hostage-taking, torture, cruel or inhuman treatment, mutilation or maiming, rape, sexual abuse or assault, hijacking, terrorism, providing material support for terrorism, and spying. CIA Abuses - The MCA, responding to the recent Supreme Court decision of Hamdan v. Rumsfeld (see June 30, 2006) that found the CIA’s secret detention program and abusive interrogation practices illegal, redefines and amends the law to make all but the most pernicious interrogation practices, even those defined as torture by the War Crimes Act and the Geneva Conventions, legal. The MCA actually rules that the Geneva Conventions are all but unenforceable in US courts. It also provides retroactive protection under the law to all actions as far back as November 1997. Under the MCA, practices such as waterboarding, stress positioning, and sleep deprivation cannot be construed as torture. [FindLaw, 10/9/2006] The MCA even states that rape as part of interrogations cannot be construed as torture unless the intent of the rapist to torture his victim can be proven, a standard rejected by international law. The MCA provides such a narrow definition of coercion and sexual abuse that most of the crimes perpetrated at Abu Ghraib are now legal. [Jurist, 10/4/2006] Although the MCA seems to cover detainee abuse for all US agencies, including the CIA, Bush says during the signing of the bill, “This bill will allow the Central Intelligence Agency to continue its program for questioning key terrorist leaders and operatives.” International law expert Scott Horton will note, “The administration wanted these prohibitions on the military and not on the CIA, but it did not work out that way.” Apparently Bush intends to construe the law to exempt the CIA from its restrictions, such as they are, on torture and abuse of prisoners. No Habeas Corpus Rights - Under the MCA, enemy combatants no longer have the right to file suit under the habeas corpus provision of US law. This means that they cannot challenge the legality of their detention, or raise claims of torture and mistreatment. Even detainees who have been released can never file suit to seek redress for their treatment while in US captivity. [FindLaw, 10/25/2006]
Retroactive Immunity - The administration added a provision to the MCA that rewrote the War Crimes Act retroactively to November 26, 1997, making any offenses considered war crimes before the MCA is adopted no longer punishable under US law. Former Nixon White House counsel John Dean will write in 2007 that the only reason he can fathom for the change is to protect administration officials—perhaps including President Bush himself—from any future prosecutions as war criminals. Dean will note that if the administration actually believes in the inherent and indisputable powers of the presidency, as it has long averred, then it would not worry about any such criminal liability. The chart presented during the CENTCOM briefing. [Source: New York Times]A briefing by the US Central Command (CENTCOM) says that Iraq is sliding towards a complete breakdown of order. The briefing features a chart used by the military as, in the words of New York Times reporter Michael Gordon, “a barometer of civil conflict.” Gordon describes the slide as providing “a rare glimpse into how the military command that oversees the war is trying to track its trajectory, particularly in terms of sectarian fighting.” The briefing was prepared by CENTCOM’s intelligence directorate, overseen by Brigadier General John Custer. The slide contains a color-coded bar chart titled “Index of Civil Conflict,” which tracks the sharp rise in sectarian violence since the bombing of a Shi’ite shrine in February (see February 22, 2006), and documents a subsequent rise in violence despite US efforts to contain conflicts in and around Baghdad. Gordon describes the chart as tracking, among other factors, “the ineffectual Iraqi police and the dwindling influence of moderate religious and political figures,” and not so much more traditional factors like “the enemy’s fighting strength and the control of territory.” The chart shows Iraq moving quickly away from “peace,” the ideal condition on the far left of the chart, to a point labeled “chaos” on the right side. Gordon notes, “As depicted in the command’s chart, the needle has been moving steadily toward the far right of the chart.” A CENTCOM official says, “Ever since the February attack on the Shiite mosque in Samarra, it has been closer to the chaos side than the peace side.” [New York Times, 11/1/2006]
The New York Times pens an editorial issuing a grim warning about the ramifications of the newly passed Military Commission Act (MCA—see October 17, 2006). The editorial calls the law’s stripping of habeas corpus rights for so-called “enemy combatants” “undemocratic.” It criticizes the highly charged rhetoric of the Republicans who attacked Democrats in opposition to the law as part of the Republican Party’s “scare-America-first strategy” for the upcoming midterm elections. The Times notes that President Bush misled the country into believing that the MCA is the only way the country has of adequately putting 9/11 suspects on trial: “The truth is that Mr. Bush could have done that long ago, but chose to detain them illegally at hidden CIA camps to extract information. He sent them to Guantanamo only to stampede Congress into passing the new law. The 60 or so men at Guantanamo who are now facing tribunals—out of about 450 inmates—also could have been tried years ago if Mr. Bush had not rebuffed efforts by Congress to create suitable courts. He imposed a system of kangaroo courts that was more about expanding his power than about combating terrorism.” The editorial criticizes Bush’s new “separate system of justice for any foreigner whom Mr. Bush chooses to designate as an ‘illegal enemy combatant,” one that “raises insurmountable obstacles for prisoners to challenge their detentions [and] does not require the government to release prisoners who are not being charged, or a prisoner who is exonerated by the tribunals.” However, the editorial gives false comfort to its readers by asserting that the MCA “does not apply to American citizens, but it does apply to other legal United States residents.” [New York Times, 10/19/2006]
Times Errs in Stating MCA Does Not Apply to US Citizens - Most other mainstream media outlets do not mention the possibility of the MCA applying to US citizens. But on the same day as the Times editorial, author and investigative journalist Robert Parry gives a powerful argument that the MCA can indeed be applied to them. The MCA reads in part, “Any person is punishable as a principal under this chapter who commits an offense punishable by this chapter, or aids, abets, counsels, commands, or procures its commission.… Any person subject to this chapter who, in breach of an allegiance or duty to the United States, knowingly and intentionally aids an enemy of the United States… shall be punished as a military commission… may direct.” The legal meaning of “any person,” Parry notes, clearly includes US citizens, particularly those who may act “in breach of an allegiance or duty to the United States.” Parry asks, “Who has ‘an allegiance or duty to the United States’ if not an American citizen? That provision would not presumably apply to Osama bin Laden or al-Qaeda, nor would it apply generally to foreign citizens. This section of the law appears to be singling out American citizens.” If an American citizen is charged with a crime under the MCA, that citizen, like the foreign nationals currently laboring under the weight of the law, cannot challenge their detention and charges under the habeas corpus provisions of US law, and cannot expect a fair trial. They will not be given the chance to appeal their convictions until they are prosecuted, convicted, and sentenced. And since the MCA defendant has no right to a “speedy trial,” that defendant cannot expect to be granted an appeal in any reasonable length of time. In effect, an American citizen, like a foreign national charged under the MCA, can be imprisoned indefinitely without recourse to the US judiciary.
Potential to Jail Media Leakers and Reporters - One aspect of the MCA that has not been widely discussed, Parry notes, is the provision that would allow the incarceration of “any person” who “collects or attempts to collect information by clandestine means or while acting under false pretenses, for the purpose of conveying such information to an enemy of the United States.” That provision is tremendously vague, and could easily be stretched to fit, for example, the whistleblowers who revealed the existence of the NSA’s warrantless wiretapping program to the Times (see December 15, 2005) and the reporters and editors who published the story based on those revelations. [Consortium News, 10/19/2006] Six months later, a Justice Department lawyer will confirm that the Bush administration believes MCA does indeed apply to US citizens (see February 1, 2007).
John Yoo, a former Justice Department official, celebrates the passage of the Military Commissions Act (see October 17, 2006). Yoo writes that Congress has ordered “the courts, in effect, to get out of the war on terror.” The bill is not so much a victory for the presidency, Yoo writes, as it is a loss for the judiciary, a “stinging rebuke to the Supreme Court. It strips the courts of jurisdiction to hear any habeas corpus claim filed by any alien enemy combatant anywhere in the world.” It supersedes the Court’s ruling in Hamdan v. Rumsfeld (see June 30, 2006), which Yoo calls “an unprecedented attempt by the court to rewrite the law of war and intrude into war policy… [a] stunning power grab.” Now, he writes: “Congress and the president did not take the court’s power grab lying down. They told the courts, in effect, to get out of the war on terror, stripped them of habeas jurisdiction over alien enemy combatants, and said there was nothing wrong with the military commissions. It is the first time since the New Deal that Congress had so completely divested the courts of power over a category of cases. It is also the first time since the Civil War that Congress saw fit to narrow the court’s habeas powers in wartime because it disagreed with its decisions. The law goes farther. It restores to the president command over the management of the war on terror. It directly reverses Hamdan by making clear that the courts cannot take up the Geneva Conventions. Except for some clearly defined war crimes, whose prosecution would also be up to executive discretion, it leaves interpretation and enforcement of the treaties up to the president. It even forbids courts from relying on foreign or international legal decisions in any decisions involving military commissions.” Yoo had previously authored numerous torture memos (see October 4, 2001, November 6-10, 2001, November 20, 2001, December 21, 2001, December 28, 2001, January 9, 2002, January 11, 2002, January 14, 2002, January 22, 2002, January 24-26, 2002, March 13, 2002, July 22, 2002, August 1, 2002, August 1, 2002, and March 14, 2003) and opinions expanding the power of the president (see September 21, 2001, September 25, 2001, September 25, 2001, October 23, 2001, October 23, 2001, and June 27, 2002). The EPA quietly closes its Office of Prevention, Pollution, and Toxic Substances (OPPTS) Library, packing its paper-only collection of documents into boxes and storing them in a basement cafeteria. The uncataloged collection is now completely unaccessible to government scientists. The library was used by EPA scientists who review applications from chemical companies who want to market new chemicals. Critics say the closure will make it more difficult for EPA scientists to determine the safety of new chemicals. In violation of federal policy (Office of Budget & Management Circular A-130), the agency issued no public notice about dismantlement of the library. [PEER, 10/30/2006] Not even the scientists who use the library were given prior notice. [PEER, 11/20/2006] Nor was the library included in the “EPA FY 2007 Framework” listing libraries slated to be shut down. [PEER, 10/30/2006] The library’s collections is supposed to be distributed to other EPA libraries, but some of the documents will be tossed into garbage bins (see October 20, 2006 and After).
Exercising its new authority under the just-signed Military Commissions Act (MCA—see October 17, 2006), the Bush administration notifies the US District Court in Washington that it no longer has jurisdiction to consider 196 habeas corpus petitions filed by Guantanamo detainees. Many of these petitions cover multiple detainees. According to the MCA, “no court, justice, or judge” can consider those petitions or other actions related to treatment or imprisonment filed by anyone designated as an enemy combatant, now or in the future. The MCA is already being challenged as unconstitutional by several lawyers representing Guantanamo detainees. The MCA goes directly against two recent Supreme Court cases, Rasul v. Bush (see June 28, 2004) and Hamdan v. Rumsfeld (see June 30, 2006), which provide detainees with habeas corpus and other fundamental legal rights. Many Congressional members and legal experts say that the anti-habeas provisions of the MCA are unconstitutional. For instance, Senator Arlen Specter (R-PA) notes that the Constitution says the right of any prisoner to challenge detention “shall not be suspended” except in cases of “rebellion or invasion.” [Washington Post, 10/20/2006] Law professor Joseph Margulies, who is involved in the detainee cases, says the administration’s persistence on the issue “demonstrates how difficult it is for the courts to enforce [the clause] in the face of a resolute executive branch that is bound and determined to resist it.” Vincent Warren of the Center for Constitutional Rights, which represents many of the detainees, expects the legal challenges to the law will eventually wind up before the Supreme Court. After an investigation into whether an Israeli lobbying organization improperly tried to influence House Minority Leader Nancy Pelosi (D-CA) into naming Jane Harman (D-CA) as the chairman of the House Intelligence Committee (see Summer 2005 and October 2005) becomes public knowledge, Harman calls the allegations “irresponsible, laughable, and scurrilous.” Former Solicitor General Theodore Olson, a Republican just hired by Harman to represent her in the matter, tells Time reporter Timothy Burger: “Congresswoman Harman has asked me to follow up on calls you’ve had. She is not aware of any such investigation, does not believe that it is occurring, and wanted to make sure that you and your editors knew that as far as she knows, that’s not true.… No one from the Justice Department has contacted her.” Burger notes that “[i]t is not, however, a given that Harman would know that she is under investigation.” Olson confirms that Harman hired him because even though she doesn’t believe the media reports of the investigation, she takes the possibility seriously. The American Israel Public Affairs Committee (AIPAC), allegedly Harman’s partner in the scheme, also denies any wrongdoing, and says it takes no position on the question of who wins the committee assignment, which was perceived to be a contest between Harman and fellow committee member Alcee Hastings (D-FL). AIPAC spokesman Patrick Dorton says: “Both Congressman Hastings and Congresswoman Harman are strong leaders on issues of importance to the pro-Israel community and would be exemplary Democratic leaders for the House intelligence committee. AIPAC would never engage in a quid pro quo in relation to a federal investigation or any federal matter and the notion that it would do so is preposterous. AIPAC is not aware that the Justice Department is looking into issues involving the intelligence committee, and has not been asked any questions or contacted by the government on this matter, but certainly would cooperate with any inquiry.” Dorton adds that AIPAC has previously been assured that the organization and its current employees are not being investigated. On October 20, the EPA quietly closed its Office of Prevention, Pollution, and Toxic Substances (OPPTS) Library, which housed thousands of one-of-a-kind documents relating to the safety of chemicals (see October 20, 2006). Material from the library had been used by government scientists to review industry applications for new chemicals. Since the closure, the agency has asked other EPA libraries to take possession of the documents. But documents that have not been claimed by other libraries are being tossed into garbage bins. Jeff Ruch, of the organization Public Employees for Environmental Responsibility (PEER), has been an outspoken critic of the EPA library closures. According to him, it appears as if “the appointed management at EPA is determined to actually reduce the sum total of human knowledge. EPA is not an agency renowned for its speed, so its undue haste in dumping library holdings suggests a political agenda rather than anything resembling a rational information management plan.” [PEER, 11/20/2006]
In an interview with WDAY’s Scott Heinen, Vice President Dick Cheney says it was a “no-brainer for me” to authorize waterboarding of suspected terrorists (see April 2002 and After and Summer 2003). Cheney says that since waterboarding and other brutal methods are not torture, as he defines the term (see Mid-March 2002), the entire issue is not really an issue. “We don’t torture,” he says. “That’s not what we’re involved in. We live up to our obligations in international treaties that we’re party to, and so forth. But the fact is, you can have a fairly robust interrogation program without torture, and we need to be able to do that.” [Savage, 2007, pp. 154-155; Financial Times, 10/26/2008] After Cheney’s statement causes a welter of criticism among lawmakers and media figures, the White House says Cheney was not talking about waterboarding, and insists that the US does not torture. Cheney calls reporters to bolster the denial. “I did not talk about specific techniques and won’t,” he says. “I didn’t say anything about waterboarding.… He [Heinen] didn’t even use that phrase.” Human Rights Watch says Cheney’s remarks are “the Bush administration’s first clear endorsement” of waterboarding. Officials at NASA and the Department of Commerce confirm that the inspectors general of both agencies have begun investigations into whether the White House has sought to prevent government climate scientist from conveying their findings to the public. The investigations were prompted by a request from 14 Democratic senators in late September (see September 29, 2006). The inquiries are expected to be completed by early 2007. [Source: Army Times / Grantham University]An Army Times editorial says that to tell the “hard bruising truth” of the war in Iraq is to conclude that Defense Secretary Donald Rumsfeld must resign. The editorial observes, “One rosy reassurance after another has been handed down by President Bush, Vice President Cheney and… Rumsfeld: ‘mission accomplished’ (see May 1, 2003 and April 30, 2008), the insurgency is ‘in its last throes” (see Summer 2005), and ‘back off,’ we know what we’re doing (see May 2004), are a few choice examples.” Some retired and active generals and military leaders are now beginning to speak out (see April 13-14, 2006, April 14-16, 2006, April 16, 2006, and October 5, 2006). In August, US CENTCOM commander General John Abizaid predicted the possibility of all-out civil war in Iraq (see August 3, 2006). And in mid-October, the New York Times reported on a confidential CENTCOM briefing that called the situation in Iraq “critical,” and sliding towards “chaos” (see October 18, 2006). The Army Times editorial observes that “despite the best [US] efforts… the problem of molding a viciously sectarian population into anything resembling a force for national unity has become a losing proposition.” Bush has vowed to stick by Rumsfeld for the remainder of his second term. The Army Times calls that decision “a mistake.” It explains: “It is one thing for the majority of Americans to think Rumsfeld has failed. But when the nation’s current military leaders start to break publicly with their defense secretary, then it is clear that he is losing control of the institution he ostensibly leads.… Rumsfeld has lost credibility with the uniformed leadership, with the troops, with Congress and with the public at large. His strategy has failed, and his ability to lead is compromised. And although the blame for our failures in Iraq rests with the secretary, it will be the troops who bear its brunt.… Donald Rumsfeld must go.” [Army Times, 11/6/2006] The Department of Defense responds to an advance copy of the Army Times editorial a day before its official publication. The editorial is “inaccurate and misleading,” and took Abizaid’s words “out of context.” The Pentagon claims that Rumsfeld has always presented what it calls a “balanced” picture of Iraq, and has never engaged in “rosy scenarios” to mislead the public (see April 11, 2003, April 12, 2003, Summer 2005, June 25, 2005, November 1, 2005, February 17, 2006, and April 18, 2006). It goes on to call the editorial little more than a rehash of old criticisms, and chides the writer(s) for “insulting military commanders” and “attack[ing]” Rumsfeld. [US Department of Defense, 11/5/2006] Rumsfeld resigns on the same day as the editorial appears (see November 6-December 18, 2006).
Slate’s war reporter, Fred Kaplan, publishes an online editorial in response to the morning’s Army Times editorial calling for the resignation of Defense Secretary Donald Rumsfeld (see November 6, 2006). Kaplan’s editorial is published just hours before Rumsfeld resigns (see November 6-December 18, 2006). Kaplan calls the editorial “fairly astonishing.” He explains the use of the word “fairly” by noting that the Army Times, and its brethren Military Times Media Group publications Navy Times, Air Force Times, and Marine Corps Times (all of which publish the Army Times editorial) are privately owned and published by the Gannett Corporation. Had the official Defense Department publication Stars & Stripes published the editorial, Kaplan writes, “it would be prelude to insurrection.” Kaplan notes that the Military Times audience is almost all military personnel; and the reporters and editors “are nearly all veterans with close ties to the senior officer corps.” The publications are, Kaplan writes, “essentially trade papers, covering issues from the perspective of the men and women of the armed forces.” The Military Times publications “would not run an editorial like the one in today’s editions unless they knew that it reflected a broad and deep consensus among high-ranking, active-duty officers across the military establishment,” he writes: “That’s the remarkable thing about the editorial—that the military’s disaffection from the war, and from its civilian leadership, has grown so widespread that even the editors of the Military Times newspapers fear no backlash from amplifying the chorus.” Kaplan adds his own voice to the Military Times’s call for Rumsfeld’s firing, writing: “Rumsfeld chose the strategy for this war. As the Defense Department’s chief civilian authority, he had every right to overrule his military commanders and impose his own notion of how to fight the war. But once his way proved disastrous, he should have been held accountable. The only person who can hold him accountable is the president. Most presidents fire a Cabinet officer whose judgment is no longer deserving of trust.” [Slate, 11/6/2006]
Democrats, who will have control of both houses when Congress reconvenes next year, say they intend to push for legislation that will lower drug prices and tighten regulation of the pharmaceutical industry. They want to encourage the development of more generic drugs, allow imported drugs from Canada, investigate drug pricing and advertising, repeal legislation that limits vaccine manufacturers’ liability, and give the government the authority to negotiate lower drug prices for people on Medicare. [New York Times, 11/24/2006; Associated Press, 11/24/2006] In response, the drug industry begins hiring lobbyists with Democratic connections, with the hope of preventing the passage of these initiatives (see After November 7, 2006).
The CIA acknowledges that it has operated under the rubric of two secret Bush administration documents that authorized it to detain and interrogate terrorism suspects overseas. Since 2004, the agency has refused to either confirm or deny the existence of the documents, and has argued in court that to make such an acknowledgement would jeopardize national security. The American Civil Liberties Union, which has fought the CIA in court over the documents, says in a statement by its executive director, Anthony Romero: “The CIA’s sudden reversal on these secret directives is yet more evidence that the Bush administration is misusing claims of national security to avoid public scrutiny. Confusion about whether such a presidential order existed certainly led to the torture and abuse scandal that embarrassed America. With a new Congress and renewed subpoena power, we now need to look up the chain of command.” One of the documents is a secret executive order signed by President Bush authorizing the CIA to set up “black site” detention facilities overseas (see September 17, 2001), and the other is a Justice Department legal analysis specifying interrogation methods that CIA interrogators could use against top al-Qaeda suspects. In legal papers previously filed in court, the CIA claimed that national security would be gravely injured if the CIA were compelled to admit or deny even an “interest” in interrogating detainees. Today, however, the agency acknowledges the existence of the two documents. It continues to withhold the documents themselves; their contents remain unknown to the public. The ACLU’s Jameel Jaffer says: “We intend to press for the release of both of these documents. If President Bush and the Justice Department authorized the CIA to torture its prisoners, the public has a right to know.” [American Civil Liberties Union, 11/14/2006]
At a Pharmaceutical Research and Manufacturers of America (PRMA) board meeting, top executives from two dozen drug companies meet to work on a strategy to prevent the incoming Democratically-controlled Congress from passing legislation that would lower drug prices and tighten regulation of the industry (see After November 7, 2006). Their top concern is a bill they expect Democrats to push that would allow the government to negotiate lower drug prices for millions of older Americans on Medicare. Lobbyists for the industry concede that it is probable that such legislation will be passed by the House. But they say they are determined to have it killed in the Senate. If their efforts fail, and the Senate does pass such a bill, the drug industry believes that President Bush would veto it and that the veto would be upheld by the remaining Republicans in the Senate. Among those attending the meeting are Kevin Sharer, chairman of Amgen; Jeffrey B. Kindler, chief executive of Pfizer; Sidney Taurel, chairman of Eli Lilly; and Richard T. Clark, chief executive of Merck. [New York Times, 11/24/2006]
Four incoming House Democratic committee chairs write a letter to EPA Administrator Stephen Johnson demanding that the agency immediately cease the “destruction or disposition of all [EPA] library holdings… and that all records of library holdings and dispersed materials” be kept safe. On October 1, the EPA closed several regional libraries and has since boxed up or destroyed collections from these libraries as part of a library reorganization plan. The closures were prompted by Bush’s 2007 budget request which slashed funding for the EPA’s network of technical libraries (see Early February 2006). However, neither the budget request nor the reorganization plan has been approved by Congress. [Gordon et al., 11/30/2006 ; Public Employees for Environmental Responsibility (PEER), 12/8/2006] The next day, on December 1, the EPA, apparently ignoring the senators’ request, removes thousands of documents from the website of the Office of Prevention, Pollution, and Toxic Substances (OPPTS) Library [Stoss, 12/4/2006 ; Public Employees for Environmental Responsibility (PEER), 12/8/2006] , which was quietly shut down about six weeks ago (see October 20, 2006).

[Source: New York Times]Several military analysts who serve as part of the Pentagon’s propaganda campaign to push the Iraq war and occupation (see April 20, 2008 and Early 2002 and Beyond) emphasize their willingness to cooperate with the program even as they come to believe that they are being manipulated and deceived. NBC analyst Kenneth Allard, who has taught information warfare at the National Defense University, will later say that he has discerned an ever-widening gap between what he and his fellow analysts are being told and what subsequent investigation and book analyses will later reveal. Allard will say, “Night and day, I felt we’d been hosed.” Yet Allard continues to repeat Pentagon talking points on NBC. Other analysts feel fewer qualms. Thomas McInerney, a retired Air Force general and Fox News analyst, writes to the Pentagon regarding the talking points they have given him: “Good work. We will use it.” [New York Times, 4/20/2008]
Scientist Bruce Ivins begins to believe that the FBI anthrax attacks investigation is turning its focus towards him. He is correct, but it is unclear how he knows this (the FBI begins openly monitoring him at some point in 2007 (see Autumn 2007-July 29, 2008)). At USAMRIID, the US Army’s top bioweapons laboratory, he tells colleagues that the FBI might be trying to set him up to take the fall for the attacks. His former boss Jeffrey Adamovicz will later recall that Ivins begins to poke holes in the FBI’s efforts. For instance, Ivins says a positive DNA match between the anthrax in the letters and anthrax at USAMRIID would mean little, “because those labs are shared.” [Wall Street Journal, 8/7/2008] It is unclear why the FBI is suspecting Ivins already, because a match between the anthrax used in the attacks and anthrax held by him will not be made until early 2007 (see Early 2007).
The Director of National Intelligence, John Negroponte, and NSA Director Keith Alexander try to get a lawsuit dismissed that alleges the NSA illegally wiretapped a Saudi charitable organization (see February 28, 2006). The organization, the Al Haramain Islamic Foundation, is presenting a classified US document as proof of the illegal wiretapping.
Invoking 'State Secrets' Privilege - In late 2006, Negroponte and Alexander tell the presiding judge, US District Judge Garr King, that in order to defend itself, the government would have to disclose “state secrets” (see March 9, 1953) that would expose US anti-terrorism efforts. This same argument will be reiterated in July 2007, when government lawyers say, “Whether plaintiffs were subjected to surveillance is a state secret, and information tending to confirm or deny that fact is privileged.” The judge will hear arguments for and against dismissing the case on August 15, 2007. Judicial Examination - King, in Portland, Oregon, examined the document for himself, and read classified briefs supplied by the Justice Department. Upon reading the briefs, King met with government lawyers to discuss turning over yet more documents in discovery—a decision unlikely to have been taken had King not believed the evidence did not show that the Al Haramain plaintiffs were, in fact, monitored. And, under FISA, had the surveillance been lawful and court-ordered, King would have been legally constrained to dismiss the lawsuit, since according to that law, plaintiffs can only sue if no warrant was ever issued for the alleged surveillance. “If there was a FISA warrant, the whole case would have crumbled on the first day,” says plaintiff attorney Thomas Nelson, “It’s pretty obvious from the government’s conduct in the case, there was no warrant.”
'Inherent Authority' of President - Justice Department lawyers rely on the argument that the president has the inherent authority to order surveillance of suspected terrorists with or without warrants, and that to judge the president’s decision would reveal national secrets that would alert terrorists to government anti-terrorist actions, thereby mandating that this and other lawsuits be dismissed.
Consolidation of Lawsuits - An August 2006 court ruling ordering that the Al Haramain case be consolidated with 54 other NSA-related lawsuits, under US District Court Judge Vaughn Walker, damaged the government’s argument that it cannot be sued in court. Walker has presided over the year-old class-action lawsuit brought before his court by the Electronic Frontier Foundation against AT&T for the telecom firm’s cooperation with the NSA program (see January 31, 2006); Walker ruled in July 2006 that the case would proceed, against government requests that it be thrown out because of national security requirements. Walker ruled that because the government had already admitted to the existence of the program, the state secrets privilege does not apply. (The Justice Department is appealing Walker’s decision.) As for Al Haramain, its lawyers want that case to be adjudicated separately, because the court has sufficient evidence to decide on the case without waiting for the appellate court decision. Another lawyer for the plaintiffs, Jon Eisenberg, tells Walker in February 2007, “You need only read the statutes to decide, ‘Does the president have the right to do this without a warrant?’” Walker has yet to rule on that request. National Defense Intelligence College logo. [Source: National Defense Intelligence College]A study just released by the Intelligence Science Board, a wing of the National Defense Intelligence College, suggests that after the 9/11 attacks, when US military and intelligence agency interrogators were asked to use harsher tactics on suspected terrorists to find out information about upcoming attacks, the interrogators were not sure how to implement such tactics. Therefore, they began “mak[ing] it up on the fly,” the study finds. It continues, “Th[e] shortfall in advanced, research-based interrogation methods at a time of intense pressure from operational commanders to produce actionable intelligence from high-value targets may have contributed significantly to the unfortunate cases of abuse that have recently come to light.” [Congressional Quarterly, 4/4/2008]
The Bush administration imposes what reporter and author Charlie Savage will later call “unprecedented controls” on scientists working with the US Geological Survey (USGS), an agency that studies environmental issues such as global warming and endangered species. Now, USGS scientists must submit research papers and prepared speeches to White House officials for approval prior to dissemination. The rules also require the scientists to let the public affairs office know about “findings or data that may be especially newsworthy, have an impact on government policy, or contradict previous public understanding to ensure that proper officials are notified and that communication strategies are developed.” USGS scientists say that the restrictions mean that government officials are monitoring and censoring their work. “The explanation was that this was intended to ensure the highest possible quality research,” says Jim Estes, a marine biologist who has worked for USGS since the 1970s. “But to me it feels like they’re doing this to keep us under their thumbs.” [Savage, 2007, pp. 106-107]
Congress passes a bill that restates an existing ban on government officials opening citizens’ first-class mail without a warrant. The single exception is if authorities suspect a letter or package of containing a bomb. President Bush issues a signing statement asserting the right of the executive branch to open mail without a warrant when “specifically authorized by law for foreign intelligence collection.” The statement, if interpreted as legally meaningful, renders Congress’s law impotent, since during the entire warrantless wiretapping controversy the administration has asserted it is authorized by the “law” of the president’s inherent power as commander in chief to intercept phone calls without a judge’s approval, and this power would also apply to opening mail. [Savage, 2007, pp. 238]
Congress passes a law prohibiting the US from transferring nuclear technology to India if that nation violates international nonproliferation guidelines. President Bush signs the law, then issues a signing statement saying that since only he has the right to determine US foreign policy, he views the legal ban as nothing more than “advisory.” [Savage, 2007, pp. 239]
The US Geological Survey establishes new rules requiring the screening of all facts and interpretations by agency scientists. The rules say that the USGS’s communications office must be “alerted about information products containing high-visibility topics or topics of a policy-sensitive nature.” Such “products” include all public documents, even minor reports or prepared talks. P. Patrick Leahy, USGS’s head of geology and its acting director, insists the new requirements are being implemented to improve scientists’ accountability, maintain their neutrality, and “harmonize” the review process. Jim Estes, an internationally recognized marine biologist in the USGS field station at Santa Cruz, Calif, disagrees. “I feel as though we’ve got someone looking over our shoulder at every damn thing we do,” he says, adding that he thinks the motivation behind the new rules is “to keep us under their thumbs. It seems like they’re afraid of science. Our findings could be embarrassing to the administration.” [Associated Press, 12/13/2006]
The Electronic Frontier Foundation files a lawsuit against the Department of Homeland Security in an effort to obtain more information about a secret program called the Automated Targeting System (ATS) (see 2002 and After). This program allows the government to assign terror risk numbers to American citizens who enter or leave the US. The suit demands an expedited response to the Freedom of Information Act (FOIA) request it filed earlier in the month. Frontier Foundation Senior Counsel David Sobel says, “DHS needs to provide answers, and provide them quickly, to the millions of law-abiding citizens who are worried about this ‘risk assessment’ score that will follow them throughout their lives.” [Electronic Frontier Foundation, 12/19/2006]
Outgoing Defense Secretary Donald Rumsfeld (see November 6-December 18, 2006) holds one of his final meetings with a group of retired military officers who serve as “independent analysts” for various television news broadcasts. The analysts are integral parts of a widespread Pentagon propaganda operation designed to promote the Iraq war (see April 20, 2008 and Early 2002 and Beyond).
Vitriolic Comments - Rumsfeld, who is accompanied by the chairman of the Joint Chiefs of Staff, General Peter Pace, is unrestrained in his contempt for a number of Iraqis and Americans involved in the occupation. According to Rumsfeld, Iraq’s interim Prime Minister, Ibrahim al-Jaafari, is an ineffectual “windsock.” Anti-American Shi’ite cleric Moqtada al-Sadr is “a 30-year-old thug” who wants “to create a Hezbollah” in Iraq; al-Sadr, in Rumsfeld’s estimation, is “not a real cleric and not well respected. [Grand Ayatollah] Sistani has, of course, all the respect… and he doesn’t like him.… He opposes what he does, but he at the present time has (a) survived (b) does not have perfect control over the Sadr elements.” He lauds former US ambassador to Afghanistan Zalmay Khalilzad, a fellow neoconservative who now serves as the US ambassador to Iraq, but in the next breath lambasts Khalilzad’s successor in Afghanistan, Ronald Neuman. “The guy who replaced him is just terrible—Neuman,” Rumsfeld says. “I mean he’s a career foreign service officer. He ought to be running a museum somewhere. That’s also off the record. No, he ought to be assistant to the guy… I wouldn’t hire the guy to push a wheelbarrow.”
Rewriting History - When Rumsfeld is asked about former Army Chief of Staff General Eric Shinseki’s statement that he believed it would take several hundred thousand US troops to keep the peace in post-invasion Iraq (see February 25, 2003), Rumsfeld attempts to rewrite history, suggesting that he was ready to send more troops, but the commanders on the ground did not want them. He is asked: “What’s become conventional wisdom, simply Shinseki was right. If we simply had 400,000 troops or 200 or 300? What’s your thought as you looked at it?” Rumsfeld replies: “First of all, I don’t think Shinseki ever said that. I think he was pressed in a congressional hearing hard and hard and hard and over again, well, how many? And his answer was roughly the same as it would take to do the job—to defeat the regime. It would be about the right amount for post-major combat operation stabilization. And they said, ‘Well, how much is that?’ And I think he may have said then, ‘Well maybe 200,000 or 300,000.’” Both Pace and an analyst tell Rumsfeld that Shinseki’s words were “several hundred thousand,” and Rumsfeld continues, “Now it turned out he was right. The commanders—you guys ended up wanting roughly the same as you had for the major combat operation, and that’s what we have. There is no damned guidebook that says what the number ought to be. We were queued up to go up to what, 400-plus thousand.… They were in the queue. We would have gone right on if they’d wanted them, but they didn’t, so life goes on.” [Chicago Tribune, 5/7/2008] In reality, Rumsfeld and his deputy Paul Wolfowitz publicly derided Shinseki’s estimation, and hounded him into early retirement for his remarks (see February 27, 2003). And one of the commanders in the field that Rumsfeld cites, General James “Spider” Marks, has already noted that Rumsfeld personally denied multiple requests from the field for more troops (see April 16, 2006).

The Asian Law Caucus (ALC) receives over twenty complaints from Northern California residents reporting excessive and repeated screenings by US Customs and Border Protection agents upon their entering the country. The residents say they have been interrogated about their families, religious practices, volunteer activities, political beliefs, and political associations when they returned from traveling abroad, regardless of their First Amendment rights. The residents say their books, business cards, handwritten notes, personal photos, laptop computer files, and cell phone directories were examined and sometimes copied. When they complained, some of them were told, according to the ALC, “This is the border, and you have no rights.” [Electronic Frontier Foundation, 2/7/2008; Electronic Frontier Foundation, 2/7/2008]
Interrogation at the Border - Nabila Mango, a US citizen from San Francisco, returns from a trip to Jordan in December 2007. She will say she is told by customs officials at San Francisco International Airport to list every person she met and every place she slept. Her Arabic music books, business cards, and cell phone are examined, and she believes some of her documents are copied. [Electronic Frontier Foundation, 2/7/2008] Her daughter tries repeatedly to call her on her cell phone during the interrogation, but Mango finds that customs officials erased the records of her calls. [Washington Post, 2/7/2008] “In my 40 years in this country, I have never felt as vulnerable as I did during that interrogation,” Mango will say. “I want to find out whether my government is keeping files on me and other Americans based on our associations and ideas.” A California citizen, Amir Khan, will also say he is stopped and interrogated every time he returns to the country. He has his laptop, cell phone, and personal notebooks searched. He is never told why he is being singled out. “One customs officer even told me that no matter what I do, nothing would improve,” he will say. “Why do I have to part with my civil liberties each time I return home?” [Electronic Frontier Foundation, 2/7/2008] Software engineer Kamran Habib, a permanent US resident, has his laptop and cell phone searched three times in 2007. Now, Habib says, “every time I travel, I basically clean out my phone. It’s better for me to keep my colleagues and friends safe than to get them on the list as well.”
Search and Seizure - Maria Udy, a marketing executive in Bethesda, Maryland, will say her company laptop is seized by a federal agent as she attempts to fly from Washington’s Dulles International Airport to London. Udy, a British citizen, is told by the agent that he has “a security concern” with her. “I was basically given the option of handing over my laptop or not getting on that flight,” she will recall. Udy is told that it is standard procedure to keep the computer for 10 to 15 days; over a year later, her laptop will not have been returned, and she will not be given any explanation. A tech engineer who wishes to remain anonymous will say he has a similar experience in the same airport months earlier. The engineer, a US citizen, says a federal agent requires him to open up his laptop and type in his password. “This laptop doesn’t belong to me,” he protests. “It belongs to my company.” He has little choice; he logs on, and the agent copies down every Web site he had visited on the laptop. The Association of Corporate Travel Executives (ACTE)‘s Susan Gurley will say her organization has filed its own FOIA request to find out what happened to seized laptops and other electronic devices. “Is it destroyed right then and there if the person is in fact just a regular business traveler?” she asks. “People are quite concerned. They don’t want proprietary business information floating, not knowing where it has landed or where it is going. It increases the anxiety level.” The ALC’s Shiran Sinnar says that by examining the websites people visit and the phone numbers they store, “the government is going well beyond its traditional role of looking for contraband and really is looking into the content of people’s thoughts and ideas and their lawful political activities.” Legal experts say that if conducted inside the country, such searches would require a warrant and probable cause. The government insists that a laptop is legally the same as a suitcase, and can be opened and examined essentially at will. Law professor David Cole disagrees: “It’s one thing to say it’s reasonable for government agents to open your luggage. It’s another thing to say it’s reasonable for them to read your mind and everything you have thought over the last year. What a laptop records is as personal as a diary but much more extensive. It records every website you have searched. Every email you have sent. It’s as if you’re crossing the border with your home in your suitcase.” [Washington Post, 2/7/2008]

John Garrett, a retired Marine colonel, Fox News analyst (see April 20, 2008 and Early 2002 and Beyond), and lobbyist who helps defense firms win Pentagon contracts in Iraq, contacts the Pentagon just before President Bush announces the “surge” in Iraq (see January 10, 2007). Garrett tells Pentagon officials, “Please let me know if you have any specific points you want covered or that you would prefer to downplay.” [New York Times, 4/20/2008]
Paul Keim. [Source: Public domain]The FBI matches an anthrax sample submitted by suspect Bruce Ivins with the anthrax used in the 2001 attacks. The sample, of anthrax used by Ivins in his work, was submitted to the FBI in February 2002, but the FBI then destroyed it since it had not been prepared using a strict protocol needed for it to be used as evidence in a trial (see February 22-27, 2002). By late 2006, the FBI suspects Ivins sent the 2001 anthrax letters (see Late 2006). Also in 2006, scientists have discovered unique genetic markers in the anthrax used in the 2001 attacks and they are comparing them to other anthrax samples they have collected. A sample Ivins gave to the FBI in April 2002 does not match the anthrax in the letters. However, Paul Keim, a biologist at Northern Arizona University and an expert at distinguishing various strains of anthrax, has kept duplicates of all the anthrax samples sent to the FBI. In early 2007, Keim discovers that he still has a copy of Ivin’s February 2002 sample, known as RMR-1029, and it matches the anthrax used in the attacks. However, at least 100 scientists had access to this sample (see Late 2005-2006), if not 200 to 300 scientists (see 1997). [Frederick News-Post, 8/19/2008; New York Times, 8/20/2008]
Author Craig Unger asks a former State Department official if, had there been no attacks on 9/11, the Bush administration would have still invaded Iraq. “Absolutely,” the official replies. “They would have done it under any circumstances. Absolutely no doubt about it. They had the road map. They had the plan.” [Unger, 2007, pp. 213]
The Pentagon-sponsored “military analysts” (see April 20, 2008 and Early 2002 and Beyond) have been so successful in shaping the media response and public opinion towards the war that others in the Bush administration begin making use of them as well. General David Petraeus, newly appointed to command US forces in Iraq, meets with the analysts, presumably to craft the message they will spread in the media about the benefits of Petraeus’s appointment. [New York Times, 4/20/2008]
A 2008 Justice Department report reveals that in January 2007, the CIA prevents Justice Department investigators from questioning al-Qaeda leader Abu Zubaida, who is being held at the Guantanamo prison. The Justice Department will say the CIA’s obstruction was “unwarranted” and “hampered” an investigation by the department’s Office of Inspector General into the FBI’s knowledge of abuse by CIA and Defense Department interrogators. The CIA’s acting general counsel John Rizzo refused to grant access to Zubaida, claiming that he “could make false allegations against CIA employees.” By contrast, Defense Department officials grant the same investigators access to other Guantanamo detainees also allegedly subjected to torture. After Zubaida was captured in early 2002, the CIA subjected him to harsh torture techniques, including waterboarding (see Mid-May 2002 and After). [Newsweek, 5/20/2008]
The American Civil Liberties Union (ACLU) releases FBI documents detailing 26 eyewitness accounts of prisoners abused by US personnel at Guantanamo. The FBI chose not to follow up 17 of the accounts. “These documents contain eyewitness FBI accounts of prisoner abuse which cannot be dismissed by the administration, and only underscore the need for a comprehensive investigation into the treatment of detainees at Guantanamo Bay and other US controlled detention facilities,” says the ACLU’s Amrit Singh. “The documents also call into question the FBI’s apparent decision to not follow up on prisoner abuses by Defense Department personnel. The fact that Defense Department policy allowed this treatment does not mean that it was legal, humane, or ethical.” The documents, compiled by FBI investigators after the Abu Ghraib scandal of 2004, contain eyewitness accounts by guards and interrogators of “aggressive mistreatment, interrogations, or interview techniques of GTMO detainees by representatives of any law enforcement, military, or bureau personnel which were not consistent with bureau guidelines.” Many of the eyewitness accounts focus on insulting the detainees’ religion:
Interrogators wrapped one detainee’s head in duct tape “because he would not stop quoting the Koran.”
An interrogator bragged about forcing a detainee to listen to “satanic black metal music for hours and hours.” That same interrogator later “dressed as a Catholic priest and baptized the detainee in order to save him.”
A Marine captain was observed enraging a detainee by squatting over a Koran in a fashion that the prisoner found extremely offensive.
After compiling these accounts, the FBI apparently chose not to pursue them further, citing the fact that what it observed was authorized by Defense Department policies. Only nine of the 26 accounts were slated for follow-up investigations. One incident marked “no further interview necessary” involved draping an Israeli flag around a detainee, shackling detainees to the floor, and subjecting them to excruciatingly loud music and strobe lights. ACLU attorney Jameel Jaffer says: “The FBI appears to have turned a blind eye to the very abuses that most need investigating—those abuses that were expressly authorized by Defense Department policy. The FBI documents only remind us that a thorough and independent investigation is long overdue.” [American Civil Liberties Union, 1/3/2007]
J. William Leonard, the director of the National Archives’s Information Security Oversight Office (ISOO), writes to Attorney General Alberto Gonzales requesting an opinion on Vice President Dick Cheney’s decision to exempt his office from the mandate of Executive Order 12958. The order requires that everyone in the executive branch take steps to protect and secure classified information regarding national security, and report periodically to the ISOO (see 2003). Cheney’s position is that the vice president’s office is not strictly part of the executive branch. Leonard notes that until 2002 Cheney’s office did submit such reports to the ISOO. He also notes that under the Constitution, the vice president’s office is indeed part of the executive branch, and that if it is not, then it is in repeated material breach of national security laws, as it has had routine access to top secret intelligence reports and other materials that are only available to the executive branch. Leonard asks Gonzales to determine that Cheney’s office does indeed fall under the mandate of the executive order. [Source: Jordan Times] (click image to enlarge)In a major policy speech regarding Iraq, President Bush announces that he will order 21,500 more US combat troops to Iraq, in a troop escalation he calls a “surge.” The bulk of the troops will be deployed in and around Baghdad. In addition, 4,000 Marines will go to the violent al-Anbar province. In announcing the escalation, he concedes a point he has resisted for over three years, that there have not been enough US troops in Iraq to adequately provide security and create conditions favorable for an Iraqi democracy to take hold. He admits that his previous strategy was based on flawed assumptions about the unstable Iraqi government. “Where mistakes have been made, the responsibility lies with me,” he says. Bush says that to consider any withdrawals of American troops would be a grave mistake, and that by increasing the number of troops in Iraq now, conditions will improve to a point at which troops can be withdrawn. “To step back now would force a collapse of the Iraqi government,” he says. “Such a scenario would result in our troops being forced to stay in Iraq even longer, and confront an enemy that is even more lethal. If we increase our support at this crucial moment, and help the Iraqis break the current cycle of violence, we can hasten the day our troops begin coming home.” Bush also commits the Iraqi government to meeting a series of “benchmarks,” tangible indicators of progress being made, that include adding a further 8,000 Iraqi troops and police officers in Baghdad, passage of long-delayed legislation to share oil revenues among Iraq’s ethnic groups, and a $10 billion jobs and reconstruction program, to be financed by the Iraqis. Bush aides insist that the new strategy is largely the conception of the Iraqi government, with only limited input from US planners. If successful, he says, the results will be a “functioning democracy” that “fights terrorists instead of harboring them.” [New York Times, 1/10/2007; ABC News, 1/10/2007; White House, 1/10/2007] While no one is sure how much the new policies will cost, Bush is expected to demand “billions” from Congress to fund his new escalation in the weeks ahead. 'New Way Forward' - The surge has a new marketing moniker, the “New Way Forward.” Some believe that the surge is more for political and public relations purposes than any real military effectiveness. “Clearly the deteriorating situation in Iraq is the overall background,” says political scientist Ole Holsti. The changes may indicate “they are looking for new bodies bringing fresh thinking…or you may have a kind of public-relations aspect,” to show Bush’s change in course is “more than just words.” [CBS News, 1/5/2007; USA Today, 1/5/2007]
Surge Already Underway - Interestingly, while Bush announces the “new” strategy of escalating the US presence in Iraq tonight, the escalation is already well underway. 90 advance troops from the Army’s 82nd Airborne are already in Baghdad, and another 800 from the same division are en route. The escalation will necessitate additional call-ups from the National Guard as well as additional reactivation of troops who have already toured Iraq and Afghanistan. Additionally, the naval group spearheaded by the aircraft carrier USS Stennis will shortly be en route to the Persian Gulf. Whether the new plan will work is anyone’s guess, say military commanders in Iraq. The escalation will take several months to implement and longer to see tangible results. One military official says, “We don’t know if this will work, but we do know the old way was failing.”
Contradicting Previous Assertions - In announcing the surge, Bush contradicts the position he has asserted since the March 2003 invasion—that military commanders were determining the direction of the war effort. Bush has repeatedly spoken of his disdain for micromanaging the war effort, and has said that he won’t second-guess his commanders. “It’s important to trust the judgment of the military when they’re making military plans,” he said in December 2006. “I’m a strict adherer to the command structure.” However, Bush balked at following the advice of many top military officials and generals, who have recommended a gradual drawdown in troop strengths, and in recent weeks replaced several top military officials who expressed doubts about the need or efficacy of new troop deployments in Iraq (see January 5, 2007). Instead, Bush believes the escalation will alleviate the drastically deteriorating security situation in Iraq. According to Pentagon officials, the Joint Chiefs of Staff, who oppose the surge, have agreed to support it only grudgingly, and only because Bush officials have promised a renewed diplomatic and political effort to go along with the escalation. Outgoing Central Command chief General John Abizaid said in November that further troop increases were not a viable answer to the Iraq situation, and in their November 30 meeting, Iraqi prime minister Nouri al-Maliki did not ask Bush for more troops, instead indicating that he wanted Iraqi troops to take a higher profile. Viewpoints differ on Bush’s interaction with his commanders up to this point—some have seen him as too passive with the generals and military advisers, allowing them almost free rein in Iraq, while others see him as asserting himself by forcing the retirements or reassignments of generals who disagree with his policies.
Rebuffing the ISG - Many observers believe the surge is a backhanded rebuff to the Iraq Study Group (see January 10, 2007).
Surge Plan Concocted at Right-Wing Think Tank - Interestingly, the surge plan itself comes largely from neoconservative planners at the American Enterprise Institute (see January 2007).
Long-Term Ramifications - The Joint Chiefs worry that a troop escalation will set up the US military for an even larger failure, without having any backup options. The Iraqis will not deliver the troops necessary for their own security efforts, they believe, and worry that US troops will end up fighting in what amounts to a political vacuum unless Bush comes up with a plan for dramatic political and economic changes to go along with the military effort. A surge could lead to increased attacks by Iraqi al-Qaeda fighters, open the troops up to more attacks by Sunni insurgents, and fuel the jihadist appeal for more foreign fighters to battle US forces in Iraq. And the escalation’s short-term conception—to last no more than six to eight months—might well play into the plans of Iraq’s armed factions by allowing them to “game out” the new strategy. The JCS also wonder just where Bush will find the troops for the surge. Frederick Kagan, one of the architects of the surge plan, and Republican presidential candidate John McCain want far more than 20,000 troops, but the Joint Chiefs say that they can muster 20,000 at best, and not all at once. Rumsfeld’s replacement, Robert Gates, played a key role in convincing the Joint Chiefs to support the escalation. The biggest selling point of the escalation is the White House’s belief that it will portray the administration as visibly and dramatically taking action in Iraq, and will help create conditions that will eventually allow for a gradual withdrawal of US troops: Bush says, “[W]e have to go up before we go down.” [Washington Post, 1/10/2007]

The CIA continues to fight an American Civil Liberties Union (ACLU) lawsuit demanding that it turn over three key memos authorizing the detention and interrogation of suspected terrorists at secret overseas “black sites” (see November 10, 2006). Court documents filed by the agency cite national security concerns for keeping the documents hidden from public scrutiny. ACLU attorney Amrit Singh says: “The CIA’s declaration uses national security as a pretext for withholding evidence that high-level government officials in all likelihood authorized abusive techniques that amount to torture. This declaration is especially disturbing because it suggests that unlawful interrogation techniques cleared by the Justice Department for use by the CIA still remain in effect. The American public has a right to know how the government is treating its prisoners.” One document is a lengthy presidential order described by the CIA as a “14-page memorandum dated 17 September 2001 from President Bush to the director of the CIA pertaining to the CIA’s authorization to detain terrorists” (see September 17, 2001). Twelve of the 14 pages are “a notification memorandum” from the president to the National Security Council regarding a “clandestine intelligence activity.” ACLU officials say this statement “raises questions regarding the extent to which Condoleezza Rice was involved in establishing the CIA detention program as national security adviser.” The CIA declares in the brief that the presidential document is so “Top Secret” that NSC officials created a “special access program” governing access to it. The brief states that “the name of the special access program is itself classified SECRET,” meaning that the CIA believes that the disclosure of the program’s name “could be expected to result in serious danger to the nation’s security.” The other two documents are, respectively, an August 1, 2002 Justice Department memo “advising the CIA regarding interrogation methods it may use against al-Qaeda members” (see August 1, 2002), and an apparent “draft” version of the August 1 memo prepared for White House counsel Alberto Gonzales by Assistant Attorney General Jay Bybee, the then-head of the Justice Department’s Office of Legal Counsel. The draft memo apparently contends that physical abuse only equates to torture under US law if it inflicts pain “equivalent in intensity to the pain accompanying serious physical injury, such as organ failure, impairment of bodily function, or even death.” The memo was later rescinded (see December 2003-June 2004). The ACLU’s Jameel Jaffer says: “Through these memos, the president and Office of Legal Counsel created a legal framework that was specifically intended to allow the CIA to violate both US and international law. While national security sometimes requires secrecy, it is increasingly clear that these documents are being kept secret not for national security reasons but for political ones.” [American Civil Liberties Union, 1/10/2007]
Attorney General Alberto Gonzales stuns Senate Judiciary Committee questioners when he says that the fundamental right of habeas corpus, the right for an accused person to go to court and challenge his or her imprisonment, is not protected by the Constitution. Gonzales, in response to questions by Arlen Specter (R-PA), says: “The Constitution doesn’t say every individual in the United States or every citizen is hereby granted or assured the right of habeas.… There is no express grant of habeas in the Constitution. There’s a prohibition against taking it away.” Specter is incredulous, asking how the Constitution could bar the suspension of a right that didn’t exist—a right, he notes, that was first recognized in medieval England as protection against the king’s power to send subjects to royal dungeons. Gonzales does say that habeas corpus is “one of our most cherished rights,” and admits that Congress has protected that right. But Gonzales refuses to acknowledge that the Constitution itself protects the right. If the Constitution does not, then Congress would be able to limit or nullify habeas corpus rights if it so chooses. Congress has not passed such an all-encompassing law yet, but it has passed a law, the Military Commissions Act, that strips the courts of any authority to hear habeas corpus suits filed by “enemy combatants.”
Experts Fear Government Encroachment on Civil Liberties - But constitutional experts on both the left and the right say that Gonzales’s position implies a far broader power. Erwin Chemerinsky, a law professor who has frequently criticized the Bush administration, says: “This is the key protection that people have if they’re held in violation of the law. If there’s no habeas corpus, and if the government wants to pick you or me off the street and hold us indefinitely, how do we get our release?” Former Reagan Justice Department official Douglas Kmiec agrees. If Gonzales’s view prevails, Kmiec says, “one of the basic protections of human liberty against the powers of the state would be embarrassingly absent from our constitutional system.” A Justice Department spokesman says that Gonzales is only noting the absence of a specific constitutional guarantee for habeas corpus, and acknowledges that the Supreme Court has declared “the Constitution protects [habeas corpus] as it existed at common law” in England. These rights, the spokesman says, do not apply to foreigners held as enemy combatants. [San Francisco Chronicle, 1/24/2007]
Habeas Protected in Constitution - The right of habeas corpus is clear in Article I, Section 9, Clause 2 of the Constitution: “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” [Think Progress, 1/19/2007]
Expansion of Presidential Powers - Former Reagan Justice Department attorney Bruce Fein says that Gonzales’s stance on habeas corpus is an underpinning of the Bush administration’s attempt to advocate the “unitary executive” theory of presidential power. Gonzales’s statements contain a message: “Congress doesn’t have to let [judges] decide national security matters. It’s part of an attempt to create the idea that during conflicts, the three branches of government collapse into one, and it is the president.” [San Francisco Chronicle, 1/24/2007]

Attorney General Alberto Gonzales sends a letter to the Senate Judiciary Committee informing it that the lawsuit against the administration’s warrantless wiretapping program (see August 17, 2006) is moot—the National Security Agency will now operate under the aegis of the Foreign Intelligence Surveillance Court (FISC) in its wiretaps. One of the FISC judges, Gonzales writes, has issued an “innovative” and “complex” order that allows the NSA to continue doing what it had been doing with the overall approval of the court, or at least the approval of the single FISC judge. Gonzales does not go into detail about the judge’s ruling, but the administration intensifies its attack on the lawsuit, asking an appeals court to set the previous ruling aside in light of the new FISC protocol, and even to erase the ruling from judicial history as a matter of “public interest.” The appeals court votes 2-1 to set aside the previous ruling; the majority opinion finds that the state secrets privilege prevents the courts from learning whether the plaintiffs in the case had the standing to sue. [Savage, 2007, pp. 207]
Two weeks after a newly Democratic Congress is sworn in, President Bush issues an executive order directing every agency head to “designate one of the agency’s presidential [political] appointees to be its regulatory policy officer [RPO].” These officers are, according to author and reporter Charlie Savage, “the president’s political enforcers, apparatchiks embedded inside each bureaucracy and empowered ‘to ensure the agency’s compliance’ with his mandates as the professionals went about making decisions on new regulations.” No new regulations or rules can be implemented without the approval of the RPO, allowing them to stop new regulations “before outsiders could learn that agency professionals had identified a health, safety, or environmental problem they thought was worth fixing.” The rule also prevents any rules from being enacted until an agency can identify a specific “market failure” that justifies government intervention instead of allowing businesses to identify and handle problems themselves. Congress had already decided that certain problems, particularly health and safety issues, should be handled through regulation. But now, Bush officials get to override Congress’s intent and allow permissive standards even when a regulation is justified. Business groups hail the decision as an aggressive new attempt to reduce “burdensome” regulations. Critics say that Bush is trying to reward special interests by choking off new rules corporate interests may oppose. The aspect of the order that gets little media attention is the abrogation of Congressional intent and the usurpation of power to the executive branch. The order “achieves a major increase in White House control over domestic government,” says law professor Peter Strauss. “Having lost control of Congress, the president is doing everything he can to increase his control of the executive branch.” [Savage, 2007, pp. 306-307]
In a second day of testimony (see January 17, 2007), Attorney General Alberto Gonzales tells the Senate Judiciary Committee that the president has always had the inherent authority to bypass or ignore statutory law if he is acting in the interest of national security. Gonzales is referring to a recent Bush administration decision to use a sympathetic FISC judge to sign off on the warrantless wiretapping program (see January 17, 2007). “We commenced down this road five years ago because of a belief that we could not do what we felt was necessary to protect this country under FISA [the Foreign Intelligence Surveillance Act],” Gonzales testifies. “That is why the president relied upon his inherent authority under the Constitution. My own judgment is, the president has shown maturity and wisdom here in this particular decision. He recognizes that there is an inherent reservoir of inherent power that belongs to every president. You use it only when you have to. In this case, we don’t have to [anymore].” Yale law professor Jack Balkin strenuously disagrees. He points to a “remarkable similarity between the administration’s behavior in the Padilla case (see October 9, 2005 and December 21, 2005) and its behavior here.… Once again, the goal is to prevent a court from stating clearly that the president acted illegally and that his theories of executive power are self-serving hokum.” Instead of going to Congress for the authority to conduct a warrantless wiretapping program, Balkin writes that the administration used FISA’s supposed deficiencies “as an excuse to disregard the law, so that it could make claims of unbridled presidential authority to ignore FISA.” [Savage, 2007, pp. 207-208; Jack Balkin, 1/18/2007]
The Bush administration confirms that it believes US citizens can be designated as “enemy combatants” under the Military Commissions Act (MCA—see October 17, 2006). The confirmation comes during the trial of Ali Saleh Kahlah al-Marri, a Qatari and the only person on the American mainland being held as an enemy combatant. Al-Marri, currently held at the Charleston, South Carolina Naval brig, is a legal US resident accused of being a sleeper agent for al-Qaeda (see September 10, 2001). He was arrested in December 2001, while living with his family and studying computer science at Bradley University in Illinois. Al-Marri is charged, not with any direct terrorist activities, but with credit card fraud and lying to federal agents. He is challenging his indefinite detention in federal court, and the government is using the MCA to argue that al-Marri has no status in the courts because of his designation as an enemy combatant. One of the appellate court judges, Roger Gregory, asks Justice Department lawyer David Salmons, “What would prevent you from plucking up anyone and saying, ‘You are an enemy combatant?’” Salmons responds that the government can do just that, without interference from the courts, and adds, “A citizen, no less than an alien, can be an enemy combatant.” Gregory and the second of the three appellate judges, Diana Gribbon Motz, seem uncomfortable with the law’s provisions that the US judiciary has no role in such designations. When Motz asks Salmons about the difference between nations making war and individuals committing acts of terrorism, Salmons retorts with a familiar, and long-disputed, argument that the US Congress gave the government the right to detain terrorist suspects without charge or recourse to the judiciary when it granted the administration the right to use military force against terrorists after the 9/11 attacks (see September 14-18, 2001).
Theoretically Declaring War on PETA - Motz is skeptical of the argument, and asks a series of hypothetical questions about just what organizations or individuals President Bush could designate as enemy combatants. Using the animal rights group People for the Ethical Treatment of Animals (PETA) as an example, Motz asks, “Could the president declare war on PETA?” Salmons says the question is unrealistic, but refuses to say that Bush could not do so if he chose. The Bush administration is careful in its use of the enemy combatant designation, Salmons says, therefore, “The representative of PETA can sleep well at night.” [New York Times, 2/2/2007]
Ignoring Constitutional Concept of 'Inalienable Rights' - Author and investigative journalist Robert Parry notes that in the al-Marri case, the Bush administration is arguing against the concept of “inalienable,” or “unalienable,” rights as granted by the Constitution and the Bill of Rights. According to the administration, as long as the US is embroiled in what it calls the “war on terror,” Bush can use his “plenary,” or unlimited, executive powers to essentially waive laws and ignore Constitutional rights if he so chooses. Parry writes that “since the ‘war on terror’ will go on indefinitely and since the ‘battlefield’ is everywhere, Bush is asserting the president’s right to do whatever he wants to whomever he wants wherever the person might be, virtually forever.” Parry concludes, “The Justice Department’s arguments in the [al-]Marri case underscore that Bush still sees himself as a modern-day version of the absolute monarch who gets to decide which rights and freedoms his subjects can enjoy and which ones will be denied.” [Consortium News, 2/3/2007]

Thom Hartmann. [Source: Pittsburgh Post-Gazette]Author and talk show host Thom Hartmann issues a call for the repeal of the Military Commissions Act (MCA) (see October 17, 2006). He frames his argument with a quote from the revered British Conservative Prime Minister, Winston Churchill: “The power of the executive to cast a man into prison without formulating any charge known to the law, and particularly to deny him the judgment of his peers, is in the highest degree odious, and the foundation of all totalitarian government whether Nazi or Communist.” The MCA is “the most conspicuous part of a series of laws which have fundamentally changed the nature of this nation, moving us from a democratic republic to a state under the rule of a ‘unitary’ president,” Hartmann writes. The MCA is an “attack on eight centuries of English law,” the foundation of US jurisprudence that goes back to 1215 and the Magna Carta. While the MCA’s supporters in and out of the administration give reassurances that the law only applies to non-citizens, Hartmann notes that two US citizens, Jose Padilla and Yaser Esam Hamdi, have already been stripped of their habeas corpus rights. Habeas corpus, Hartmann writes, is featured prominently in Article I of the US Constitution. Attorney General Alberto Gonzales was flat wrong in saying that the Constitution provided “no express grant of habeas” (see January 17, 2007), Hartmann writes. “Our Constitution does not grant us rights, because ‘We’ already hold all rights. Instead, it defines the boundaries of our government, and identifies what privileges ‘We the People’ will grant to that government.” The authors of the Constitution “must be turning in their graves,” Hartmann writes, quoting the “most conservative” of those authors, Alexander Hamilton: “The establishment of the writ of habeas corpus… are perhaps greater securities to liberty and republicanism than any it [the Constitution] contains.… [T]he practice of arbitrary imprisonments have been, in all ages, the favorite and most formidable instruments of tyranny.” Hamilton’s colleague Thomas Jefferson said that laws such as habeas corpus make the US government “the strongest government on earth.” Now, Hartmann writes, the strength of that government is imperiled. After reviewing $57 billion worth of Iraq reconstruction and troop support contracts through September 2006, auditors from the Defense Contract Audit Agency (DCAA) inform the House Committee on Oversight and Government Reform that contractors in Iraq submitted about $5.1 billion in unsupported costs (“unreasonably high”) and $4.9 billion in questionable costs (for which contractors lack proper documentation). About $2.7 billion of these unsupported or questionable billings are from Halliburton alone. [US Congress, 2/15/2007 ]
Bradley Schlozman. [Source: US Department of Justice]Congress’s new Democratic leadership decides to investigate the Bush administration’s politicization of the Justice Department’s civil rights division (CRD—see Fall 2002 and After). The investigation is part of a parallel investigation into the firing of nine US attorneys for allegedly political reasons. One of the first replacement US attorneys, Bradley Schlozman, had spent three years as one of the CRD’s political hires most responsible for hiring conservative ideologues to replace CRD career lawyers. The complaints also dovetail with a report that another key figure in the US attorney firing, the Justice Department’s White House liaison Monica Goodling, was being investigated for using partisan political affiliations as part of her decisions to hire career assistant prosecutors, a practice forbidden by federal law. Goodling will later admit to having “crossed the line” by using political litmus tests in her career hiring decisions. Scholzman will admit to having bragged about hiring only Republicans at the Justice Department, but will deny asking any job applicants about their political views or partisan affiliations. A bipartisan group of senators headed by Ron Wyden (D-OR) and Kit Bond (R-MI) campaign to force the CIA to release the executive summary of a report by its inspector general about some aspects of its performance before 9/11. Wyden says, “It’s amazing the efforts the administration is going to stonewall this,” adding that he is considering linking acceptance of President Bush’s nominations for national security positions to the report’s release. Wyden also says that the report is not being kept secret for national security reasons, but merely to protect individuals from embarrassment. Apparently, some of the officials criticized in the report are still in “senior government positions.” The idea of releasing the executive summary is twice approved by the Senate before being made law in August 2007 (see August 8, 2007). A report by Glenn Fine, the Justice Department’s Inspector General, finds that the FBI used self-issued subpoenas known as National Security Letters (NSLs) to obtain phone, e-mail, and financial information on at least 143,074 targets between 2003 and 2005. The report’s main conclusions include:
More than half of those targeted are US citizens;
In many cases FBI officials evaded limits on NSLs and sometimes illegally issued them;
60% of the audited NSLs do not follow the FBI’s rules of issuance, and a further 22% contain unreported possible violations of the law, including improper requests and unauthorized collections of information;
The number of surveillance targets is probably far higher than the audit finds, because the FBI practices poor record-keeping that allow at least 22% of surveillance to go unreported;
Fine finds that agents had routinely issued the letters even when they had no open investigation, as required by law;
One office made arrangements with telecommunications firms to get information instantly, even before issuing NSLs, by sending “exigent letters” claiming it needed the requested information because of an emergency, and that the letters and necessary court warrants were in preparation (see Before Mid-March, 2007). But, the audit finds, “we could not confirm one instance in which a subpoena had been submitted to any US attorney’s office before the exigent letter was sent to the phone companies” and that “many were not issued in exigent circumstances.”
Representative Edward Markey (D-MA), a senior member of the House Homeland Security Committee, wants hearings. “The Inspector General’s report is a scathing critique of FBI misuse of the secretive process,” Markey says. Although the FBI has used NSLs for years, their usage soared after the USA Patriot Act (see October 26, 2001) eased the restrictions on them. Now, FBI agents in counterterrorism and counterintelligence investigations can issue NSLs themselves, without court warrants or even the approval of a supervisor, as long as the agent affirms that the information they seek is “relevant” to an open investigation. The information obtained by NSLs remains in a massive “data warehouse,” where it can be accessed again for data-mining or subsequent investigations. [Wired News, 3/9/2007]
Senator Charles Grassley (R-IA) tells 60 Minutes that he has looked into the investigation of the 2001 anthrax attacks (see October 5-November 21, 2001), and has concluded that there was leaking by top government officials—not to shut down the sole publicly named suspect, Steven Hatfill, but to disguise a lack of progress in the investigation. Asked if he has any evidence that government officials knowingly planted false information in the press, Grassley replies, “I believe the extent to which they wanted the public to believe that they were making great progress in this case, and the enormous pressure they had after a few years to show that, yes, that they was very much misleading the public.” He adds that the leaking hurt the investigation: “Because it gave people an indication of where the FBI was headed for. And if you knew what that road map was, that if you were a guilty person you would be able to take action to avoid FBI.” [CBS News, 3/11/2007]

[Source: US House of Representatives]In response to a question asked at a briefing, CIA Director Michael Hayden makes an “offhand comment” to the House Intelligence Committee indicating that tapes the CIA has made of detainee interrogations have been destroyed (see Spring-Late 2002). Although some committee members have been aware of the tapes’ existence since 2003 (see February 2003), this is apparently the first time they learn of their destruction, which occurred over year ago (see November 2005). The destruction is again “briefly mentioned” in a letter to a member of the committee in mid-April. Leading committee members Silvestre Reyes and Peter Hoekstra will later write to Hayden, “We do not consider this to be sufficient notification. Moreover, these brief mentions were certainly not contemporaneous with the decision to destroy the videotapes.” [US Congress, 12/7/2007] The Senate Intelligence Committee is apparently not informed until later (see December 7, 2007).
ACLU advertisement against the Military Commissions Act. [Source: ACLU]The American Civil Liberties Union strongly objects to the stripping of habeas corpus rights contained within the Military Commissions Act (MCA—see October 17, 2006). The ACLU observes, “Habeas corpus isn’t a fancy legal term. It’s the freedom from being thrown in prison illegally, with no help and no end in sight. No president should ever be given the power to call someone an enemy, wave his hand, and lock them away indefinitely. The Founders made the president subject to the rule of law. They rejected dungeons and chose due process.” [American Civil Liberties Union, 3/28/2007]
Defense Secretary Robert Gates confirms at a House Appropriations Defense Subcommittee hearing that there are currently about 126,000 private contractors doing business in Iraq. Of those, only 20 percent are US citizens, Gates says. The rest are Iraqis and third-country nationals. [US Congress, 3/29/2007; United Press International, 4/2/2007] In July 2007, it will be reported that there are about 180,000 private contractors in Iraq (see April 4, 2007).
Private contractors paid by US firms outnumber US troops in Iraq, according to newly released figures from the State and Defense departments. Over 180,000 civilians, including Americans, foreign citizens, and Iraqis, are working under US contracts in Iraq, compared to about 160,000 soldiers and several thousand civilian government employees stationed in Iraq. The Los Angeles Times reports, “The total number of private contractors, far higher than previously reported, shows how heavily the Bush administration has relied on corporations to carry out the occupation of Iraq—a mission criticized as being undermanned.” The Brookings Institute’s Peter Singer says, “These numbers are big. They illustrate better than anything that we went in without enough troops. This is not the coalition of the willing. It’s the coalition of the billing.” The numbers of contractors include:
43,000 foreign contractors;
about 118,000 Iraqis.
These numbers are not complete; private security contractors, hired to protect government officials and buildings, were not fully counted in the survey. According to some firms’ figures, about 30,000 security personnel work in Iraq, sometimes fighting alongside—or independent of—military forces. All these employees working for private contractors are paid with US tax dollars. Military officials say contractors cut costs while allowing troops to focus on fighting rather than on other tasks. “The only reason we have contractors is to support the war fighter,” says Gary Motsek, the assistant deputy undersecretary of defense who oversees contractors. “Fundamentally, they’re supporting the mission as required.” But some are critical, noting that the US government has relied far more heavily on contractors in the Iraq war than in any other conflict in American history. Critics note that troops and their missions can be jeopardized if contractors, functioning outside the military’s command and control, refuse to make deliveries of vital supplies under fire. Just such an occurrence happened in 2004, when US forces were forced to endure food rationing after delivery drivers refused to ferry supplies into a combat zone. And the government does not keep centralized track of the number or location of contractors operating in Iraq, though the US Central Command (CENTCOM) has recently bowed to pressure from Congress and begun a census of the number of contractors working on US and Iraqi bases to determine how much food, water, and shelter is needed. The corporation with the single largest presence in Iraq is KBR, which was the Halliburton Co. subsidiary Kellogg, Brown, and Root until early 2007. KBR provides logistical support to US and Iraqi troops, and holds the single biggest contract in Iraq, employing nearly 14,000 US workers. Other large employers of Americans in Iraq include L-3 Corporation, which provides translators to troops, and engineering firm ITT. The companies that have drawn the most attention are the private security firms such as Blackwater, Triple Canopy, and Erinys. Military policy experts say these contractors’ jobs should be done by servicemen, and point out the number of times security forces have engaged in firefights with Iraqi insurgents. “We don’t have control of all the coalition guns in Iraq. That’s dangerous for our country,” says William Nash, a retired Army general and reconstruction expert. The Pentagon “is hiring guns. You can rationalize it all you want, but that’s obscene.” Others point to the almost-complete lack of governmental accountability; the Times notes that “[a]lthough scores of troops have been prosecuted for serious crimes, only a handful of private security contractors have faced legal charges.” [Los Angeles Times, 4/7/2004] (See July 3, 2007 and July 5, 2007.)

The FBI’s letter to Bruce Ivins. [Source: FBI] (click image to enlarge)Bruce Ivins is sent a formal letter by prosecutors saying that he is “not a target” of the FBI’s anthrax attacks investigation. In fact, samples of the anthrax used in the attacks have been shown to match anthrax once controlled by Ivins (see Early 2007) and Ivins has already been questioned about late-night work he had conducted in the USAMRIID laboratory shortly before the anthrax letters were mailed (see March 31, 2005). [New York Times, 9/6/2008] Since late 2006, Ivins has correctly been under the impression that he is a target of the investigation (see Late 2006).
George Christian, a Connecticut librarian and data manager who fought a National Security Letter from the FBI demanding information about his library’s patrons (see July 13, 2005 and August 2005-May 2006), testifies before the Senate Judiciary Committee. Christian, who along with his three fellow plaintiffs, has repeatedly spoken about what he considers the Justice Department’s egregrous abuse of power and its invasion of privacy, and his opposition to the USA Patriot Act, which has given the FBI the ability to not only demand private information from libraries about their patrons, but require those librarians to keep quiet about the request. Though the court battle restored Christian’s ability to speak publicly about his encounter with the FBI, he testifies, “We feel an obligation to the tens of thousands of others who received National Security Letters and now will live under a gag order for the rest of their lives.” He tells the committee, “Our saga should raise a big patriotic American flag of caution about how our civil liberties are being sorely tested by law enforcement abuses of national security letters. The questions raised vindicate the concerns that the library community and others have had for over five years about the broad powers expanded under the USA Patriot Act.… We believe changes can be made that conform to the rule of law, do not sacrifice law enforcement’s abilities to pursue terrorists ,yet maintain civil liberties guaranteed by the US Constitution.” Libraries “should remain pillars of democracy, institutions where citizens could come to explore their concerns, confident that they could find information on all sides of controversial issues and confident that their explorations would remain personal and private.” He quotes one of his fellow plaintiffs: “[S]pying on people in the library is like spying on them in the voting booth.” Christian also says that while many believe that library records are now protected by the revised Patriot Act, in fact, they are not. He says that “a loophole inserted into the wording allows the FBI to use a national security letter to obtain library records anyway.” He notes that FBI director Robert Mueller has admitted to the Senate Judiciary Committee that the new language “did not actually change the law.” Similarly, the revised Patriot Act still gives the government the power to impose near-unlimited gag orders on NSL recipients—though the new law seems to give recipients the ability to challenge such gag orders, the law says that if the government declares that lifting such a gag order would “harm national security,” the court must accept that assertion and refuse to lift the order. “Hence, there is no prior judicial review to approve an NSL and, with rare exception, no legal way to challenge an NSL after the fact,” Christian testifies. “It is the secrecy surrounding the issuance of NSLs that permits their misuse. Because of the fact that all recipients of NSLs are perpetually gagged, no one knew the FBI was issuing so many. No one knew there was no public examination of the practice. No one could ask if over 143,000 National Security Letters in two years are necessary.… Secrecy that prevents oversight and public debate is a danger to a free and open society.” [Senate Judiciary Committee, 4/11/2007]
Suzanne Spaulding. [Source: Bipartisan Security Group]Suzanne Spaulding, a national security expert with twenty years of experience in the CIA, on various Congressional oversight committees, and executive director of two separate commissions on terrorism and weapons of mass destruction, testifies before the Senate Judiciary Committee as part of that body’s hearings on the improper use of National Security Letters (NSLs) by the FBI (see October 25, 2005). Spaulding has spoken out before against the NSA’s wiretapping program (see December 25, 2005). She says that the nation’s law enforcement and intelligence agents need “the tools they need to do their job” and “clear guidance on just what it is that we want them to do on our behalf—and how we want them to do it. Clear rules and careful oversight provide essential protections for those on the front lines of our domestic counterterrorism efforts.” However, Spaulding testifies, “it appears both were lacking in the implementation of national security letter authorities.” Spaulding says that Congress should begin a much larger examination of domestic surveillance issues, saying, “The appropriateness of using FISA electronic surveillance to eavesdrop on Americans should be considered in light of other, less intrusive techniques that might be available to establish whether a phone number belongs to a suspected terrorist or the pizza delivery shop. It’s not the ‘all or nothing’ proposition often portrayed in some of the debates.” However, according to recent findings by the Justice Department’s Inspector General, Glenn A. Fine, “there is not sufficient guidance on how to apply that in the NSL context or in conjunction with other available collection techniques.” Therefore, there is a strong “need for a broader examination of domestic intelligence tools.”
Urges Congressional Review - Spaulding urges Congress “to undertake a comprehensive review of all domestic intelligence collection, not just by FBI but also by the other national security agencies engaged in domestic intelligence collection, including the Central Intelligence Agency, the Department of Defense, and the National Security Agency. A Joint Inquiry or Task Force could be established by the Senate leadership, with representation from the most relevant committees (Judiciary, Intelligence, Armed Services, and Homeland Security and Government Affairs), to carefully examine the nature of the threat inside the US and the most effective strategies for countering it. Then Congress, and the American public, can consider whether we have the appropriate institutional and legal framework for implementing those strategies with adequate safeguards and oversight.”
FBI's Expanded Powers Need Review - In addition, she testifies, the FBI’s expanded ability to use NSLs under the Patriot Act must be examined. Currently, the law seems to allow the FBI to use NSLs to obtain evidence pursuant to a FISA warrant, thus allowing “the government to get information about individuals who are not themselves the subject of an investigation”—“parties two or three steps removed from their subjects without determining if these contacts reveal suspicious connections,” Fine reported. Spaulding expands on Fine’s findings: “In fact, the most tenuous of connections would seem to suffice for this NSL standard. For example, it’s not clear why an ‘investigation to protect against international terrorism’ couldn’t justify demanding information about all residents of, say, Dearborn, Michigan [home to a large Arab-American community], so that you could run them through some logarithmic profile to identify ‘suspicious’ individuals. In fact, Congress should examine the facts surrounding the nine NSLs in one investigation that were, according to the IG Report, used to obtain information regarding over 11,000 different phone numbers.”
Data Mining Efforts Should Be Examined - Also, she says, data mining efforts by other law enforcement and intelligence agencies should be carefully examined and addressed: “NSLs should not become a mechanism for gathering vast amounts of information about individuals with no known connection to international terrorism for purposes of data mining.” Spaulding also notes that the Patriot Act allows FBI special agents in charge (SACs) to issue NSLs; instead, she says, only attorneys in the Justice Department’s National Security Division should be able to issue NSLs. Yet another problem Spaulding notes is the FBI’s policy of retention of data gathered on US citizens through NSLs, even when those citizens have no connection to terrorist activities. Spaulding expressed similar concerns in a previous op-ed for the Washington Post (see December 25, 2005). [Senate Judiciary Committee, 4/11/2007]
Former CIA manager Michael Scheuer, who ran the agency’s “rendition” program that sent suspected terrorists to foreign nations to be interrogated for information in the late 1990s (see Summer 1995 and 1997), says during a House Foreign Affairs Committee hearing that the assurances of Arab nations such as Egypt and Syria that a suspect will not be tortured are not “worth a bucket of warm spit.” Scheuer tells the assembled lawmakers that he knows of at least three mistakes that the CIA has made in its overseas rendition program, including the capture and subsequent torture of Canadian citizen Maher Arar (see September 26, 2002 and October 10, 2002-October 20, 2002). [Source: Shawn Thew / epa / Corbis]The House Oversight Committee holds a hearing focusing on misleading and false information provided to the press following the death of Army Ranger Pat Tillman in Afghanistan, and the capture and rescue of Army Private Jessica Lynch in Iraq (see March 23, 2003, April 1, 2003, and June 17, 2003).The committee focuses on how and why misinformation on the two incidents was disseminated, by whom, and if anyone in the Bush administration has been, or will be, held accountable. Lynch testifies that she is there to address “misinformation from the battlefield,” and notes, “Quite frankly, it is something that I have been doing since I returned from Iraq.” Lynch says that while she was being transported out of Iraq to a hospital in Germany: “tales of great heroism were being told. My parent’s home in Wirt County was under siege of the media all repeating the story of the little girl Rambo from the hills who went down fighting. It was not true. I have repeatedly said, when asked, that if the stories about me helped inspire our troops and rally a nation, then perhaps there was some good. However, I am still confused as to why they chose to lie and tried to make me a legend when the real heroics of my fellow soldiers that day were, in fact, legendary. People like Lori Piestewa and First Sergeant Dowdy who picked up fellow soldiers in harms way. Or people like Patrick Miller and Sergeant Donald Walters who actually fought until the very end. The bottom line is the American people are capable of determining their own ideals for heroes and they don’t need to be told elaborate tales.” She concludes: “I had the good fortune and opportunity to come home and I told the truth. Many other soldiers, like Pat Tillman, do not have the opportunity. Facing a Congressional investigation into the practice of hiring conservative ideologues for the Justice Department’s civil rights division (CRD—see Fall 2002 and After and Spring 2007), the Department reverses its 2002 decision to give political appointees the power to decide who will be hired as career CRD lawyers. Such hiring now reverts to a committee of career civil servants, as has been the case for decades. Skeptics say that the reversal means little, as the career ranks are now packed with inexperienced conservative ideologues instead of the traditional veteran, highly experienced career lawyers. William Yeomans, a 24-year CRD veteran who accepted a 2005 buyout, says the Bush administration attempted to go farther than previous conservative administrations such as Nixon and Reagan. To make changes permanent, Yeomans notes, one has to entirely reshape the CRD bureaucracy. “Reagan had tried to bring about big changes in civil rights enforcement and to pursue a much more conservative approach, but it didn’t stick,” Yeomans says. “That was the goal here—to leave behind a bureaucracy that approached civil rights the same way the political appointees did.” [Savage, 2007, pp. 300]

[Source: PBS]Jack Goldsmith, the former head of the Justice Department’s Office of Legal Counsel (see October 6, 2003 and June 17, 2004), is subpoenaed to testify in the Justice Department’s investigation of the leaks that resulted in the New York Times’s dramatic disclosure of the NSA domestic wiretapping program (see December 15, 2005). Goldsmith had spoken to one of the two Times reporters, Eric Lichtblau, in October 2004, three months after his resignation from the OLC, but lied to Lichtblau, saying he knew nothing of the program. He immediately alerted his former boss, Deputy Attorney General James Comey, of the interview.
'Stunned' By Subpoena - In his September 2007 book The Terror Presidency, Goldsmith will recall being “stunned” at the subpoena, though the two FBI agents who give him the subpoena—in public—say that they don’t suspect him as the source of the leak. Goldsmith later recalls, “What angered me most about the subpoena I received on that wet day in Cambridge was not the expense of lawyers or a possible perjury trap, but rather the fact that it was Alberto Gonzales’s Justice Department that had issued it. As [the two FBI agents] knew, I had spent hundreds of very difficult hours at OLC, in the face of extraordinary White House resistance, trying to clean up the legal mess that then-White House Counsel Gonzales, David Addington, John Yoo, and others had created in designing the foundations of the Terrorist Surveillance Program. It seemed rich beyond my comprehension for a Gonzales-led Department of Justice to be pursuing me for possibly illegal actions in connection with the Terrorist Surveillance Program….”
Supported Surveillance of Terrorism - Goldsmith will continue, “I was not opposed to the leak investigation itself or to vigorous surveillance of terrorists. I agreed with President Bush that the revelations by [James] Risen and Lichtblau had alerted our enemies, put our citizens at risk, and done ‘great harm’ to the nation. I hoped the FBI would find and punish the leakers, and I had spent many hours trying to help them do so. I also shared many of the White House’s concerns with the Foreign Intelligence Surveillance Act (FISA), the 1978 domestic wiretapping law that required executive officers, on pain of jail, to get a court warrant before wiretapping suspected enemies in the United States. We were at war with terrorists who were armed with disposable cell phones and encrypted e-mails buried in a global multibillion-communications-per-day system. It seemed crazy to require the commander in chief and his subordinates to get a judge’s permission to listen to each communication under a legal regime that was designed before technological revolutions brought us high-speed fiber-optic networks, the public Internet, e-mail, and ten-dollar cell phones. But I deplored the way the White House went about fixing the problem. ‘We’re one bomb away from getting rid of that obnoxious [FISA] court,’ Addington had told me in his typically sarcastic style during a tense White House meeting in February of 2004 (see February 2004). The vice president’s counsel, who was the chief legal architect of the Terrorist Surveillance Program, was singing the White House tune on FISA. He and the vice president had abhorred FISA’s intrusion on presidential power ever since its enactment in 1978. After 9/11 they and other top officials in the administration dealt with FISA the way they dealt with other laws they didn’t like: They blew through them in secret based on flimsy legal opinions that they guarded closely so no one could question the legal basis for the operations. My first experience of this strict control, in fact, had come in a 2003 meeting when Addington angrily denied the NSA inspector general’s request to see a copy of OLC’s legal analysis in support of the Terrorist Surveillance Program. Before I arrived in OLC, not even NSA lawyers were allowed to see the Justice Department’s legal analysis of what NSA was doing.”
Difficult to Justify Legally - Goldsmith will write of the difficulties he found in finding legal justifications for the program. “I first encountered the program in 2003-2004, long after it had been integrated into the post-9/11 counterterrorism architecture. Putting it legally aright at that point, without destroying some of the government’s most important counterterrorism tools, was by far the hardest challenge I faced in government. And the whole ordeal could have been avoided.…In 2004, I and others in the Department of Justice had begun the process of working with the FISA court to give the commander in chief much more flexibility in tracking terrorists. From the beginning the administration could have taken these and other steps to ramp up terrorist surveillance in indisputably lawful ways that would have minimized the likelihood of a devastating national security leak. But only if it had been willing to work with the FISA court or Congress. The White House had found it much easier to go it alone, in secret.” [Slate, 9/10/2007]

Bush administration officials tell Senate Intelligence Committee members that they will not promise to continue seeking warrants for surveillance on US citizens, as the administration agreed to do in January 2007. They insist that President Bush has the Constitutional authority to decide whether or not to order the NSA to conduct surveillance without warrants if he desires. The secret wiretapping program was revealed to the public just weeks before the agreement (see December 15, 2005), and immediately drew tremendous outcries of criticism from civil libertarians, from lawmakers from all across the political spectrum, and from much of the public. Since the January agreement, the Foreign Intelligence Surveillance Act (FISA) court has issued warrants for domestic wiretaps after being given evidence showing some kind of probable cause to justify the proposed surveillance. Previously, the wiretapping program had ignored the FISA restrictions. Now Bush officials, most notably the new director of national intelligence, Mike McConnell, are saying that Bush has the authority under Article II of the Constitution to order warrantless wiretaps on US citizens.
Invoking Presidential Authority - In Senate testimony on this day, Russ Feingold (D-WI) asks McConnell if he is willing to promise that the administration will no longer ignore the law and the court when monitoring citizens. McConnell replies, “Sir, the president’s authority under Article II is in the Constitution. So if the president chose to exercise Article II authority, that would be the president’s call.” McConnell is echoing previous arguments made by Bush and other officials, who have said that Bush has the power to order wiretaps without court review, both under the Constitution and under the September 2001 Congressional authorization to use military force against al-Qaeda. McConnell says that the administration is conducting surveillance against Americans only with court warrants, and has no plans “that we are formulating or thinking about currently” to resume domestic wiretapping without warrants. “But I’d just highlight,” he adds, “Article II is Article II, so in a different circumstance, I can’t speak for the president what he might decide.” [New York Times, 5/2/2007] Article II is the section of the Constitution that delineates the powers of the executive branch, and establishes the fundamental “separation of powers” doctrine that governs American democracy. Constitutional expert Steve Mount notes that the “Constitution is deliberately inefficient; the “Separation of Powers devised by the framers of the Constitution was designed to do one primary thing: to prevent the majority from ruling with an iron fist.” [Mount, 1995]
White House Seeking Congressional Authorization - While the administration continues to argue that it has the power to eavesdrop on US citizens without warrants, it also continues to seek Congressional legislation affirming and perhaps expanding that power. The White House justifies that hoped-for legislation by pointing to national security and the war on terrorism, as well as the challenges posed by new communications technologies such as e-mail and wireless communications. White House officials have consistently refused to go into specifics as to what communications gaps they feel need plugging. And they have consistently ignored Congressional requests for information and documents related to the NSA’s domestic spy program, now being called the “Terrorist Surveillance Program” by White House officials and their Republican colleagues. Many Congressional Democrats say they would be reluctant to support any such legislation until they receive the information they have requested. “To this day, we have never been provided the presidential authorization that cleared that program to go or the attorney general-Department of Justice opinions that declared it to be lawful,” says Senator Sheldon Whitehouse (D-RI). “Where’s the transparency as to the presidential authorizations for this closed program? That’s a pretty big ‘we’re not going to tell you’ in this new atmosphere of trust we’re trying to build.” [New York Times, 5/2/2007]
Haris Silajdzic [Source: Public domain]Press reports indicate that the Muslim leader of Bosnia’s tripartite presidency, Haris Silajdzic, is under investigation for international arms smuggling. Police are also said to be investigating former Bosnian Deputy Defense Minister Hasan Cengic, Elfatih Hassanein, and Turkish businessman Nedim Suljak. Hassanein was the head of the Third World Relief Agency (TWRA) and Cengic was closely tied to TWRA. During the Bosnian war in the early 1990s, TWRA was a radical militant charity front providing cover for a massive illegal arms pipeline into Bosnia (see Mid-1991-1996). Silajdzic was Bosnian foreign minister during the war. Bosnian state prosecutors confirm that a weapons smuggling investigation into international illegal weapons smuggling had opened but refuse to say who is being targeted. [Agence France-Presse, 5/5/2007] TWRA has remained active and there are reports that it is still connected to radical militants (see January 25, 2002). In late 2006, it was announced that Hassanein was opening a new charity in Bosnia. [BBC, 12/29/2006]
The trial of suspected al-Qaeda operative Jose Padilla begins in a Miami criminal court. Padilla is charged with conspiring to “murder, kidnap, and maim” people overseas. The charges include no allegations of a “dirty bomb” plot or other plans for US attacks, as have been alleged by Bush administration officials (see June 10, 2002). Two co-defendants, Adham Amin Hassoun (see 1993) and Kifah Wael Jayyousi (see (October 1993-November 2001)), also face charges of supporting terrorist organizations. “The defendants were members of a secret organization, a terrorism support cell, based right here in South Florida,” says prosecutor Brian Frazier in his opening statement. “The defendants took concrete steps to support and promote this violence.” Defense attorneys argue that Padilla, Hassoun, and Jayyousi are peaceful Muslims interested in studying their religion and helping their fellow Muslims in war-ravaged areas of the world. Padilla’s attorney, Anthony Natale, calls the case against his client the product of “the politics of fear” in the aftermath of the 9/11 attacks. “Political crises can cause parts of our government to overreach. This is one of those times,” he says. “He’s a young man who has been wrongly accused.” Hassoun’s attorney, Jeanne Baker, says: “The government really is trying to put al-Qaeda on trial in this case, and it doesn’t belong in this courtroom. There’s a lot of rhetoric, but there’s no evidence.” Much of the evidence against the three consists of FBI wiretaps, documents, and witness statements. One of the strongest pieces of evidence against Padilla is his application to attend an al-Qaeda training camp in Afghanistan in July 2000 (see September-October 2000). Prosecutors say Hassoun recruited Padilla when they met in a Florida mosque. “Jose Padilla was an al-Qaeda terrorist trainee providing the ultimate form of material support—himself,” says Frazier. “Padilla was serious, he was focused, he was secretive. Padilla had cut himself off from most things in his life that did not concern his radical view of the Islamic religion.” [Associated Press, 5/14/2007]
Former Deputy Attorney General James Comey delivers dramatic testimony before the Senate Judiciary Committee about the March 2004 attempts by then-White House counsel Alberto Gonzales and then-White House chief of staff Andrew Card to pressure a seriously ill John Ashcroft, then the attorney general, to certify the legality of the Bush/NSA domestic wiretapping program (see March 10-12, 2004, Early 2002). Comey testifies that even though he, who at the time has the full authority of the attorney general during Ashcroft’s illness, and Ashcroft both refused to authorize the program due to their belief that the program is illegal, President Bush will certify the program anyway. Only a threatened mass resignation by Ashcroft, Comey, FBI director Robert Mueller, and other senior officials will persuade Bush, weeks later, to make changes in the program that bring it somewhat closer to operating within the law. Bush Sent Gonzales, Card to Ashcroft's Hospital Room, Comey Believes - Comey says that while he cannot be certain, he believes Gonzales and Card went to Ashcroft’s hospital room on orders from President Bush: “I have some recollection that the call was from the president himself, but I don’t know that for sure,” he tells the committee. His major concern in heading off Gonzales and Card at the hospital, Comey testifies, is that, “given how ill I knew the attorney general was, that there might be an effort to ask him to overrule me when he was in no condition to do that.” Comey says he was “stunned” by how forceful Ashcroft was in refusing to comply with Gonzales and Card’s directive to sign the reauthorization.
Gonzales a 'Loyal Bushie' - Committee members are openly contemptuous of Gonzales’s actions, and question his fitness to serve as attorney general. “He’s presided over a Justice Department where being a, quote, loyal Bushie seems to be more important than being a seasoned professional, where what the White House wants is more important than what the law requires or what prudence dictates,” says Charles Schumer (D-NY). Arlen Specter (R-PA) is hardly less critical. “It is the decision of Mr. Gonzales as to whether he stays or goes, but it is hard to see how the Department of Justice can function and perform its important duties with Mr. Gonzales remaining where he is,” Specter says. “And beyond Mr. Gonzales’s decision, it’s a matter for the president as to whether the president will retain the attorney general or not.” [New York Times, 5/15/2007]
Not a 'Team Player' - Interestingly, President Bush views Comey with disdain because Comey isn’t what Bush calls a “team player;” Bush earlier tagged Comey, who resigned his position in 2005 and who previously tangled with the White House over its embrace of torture for terrorist suspects, with the derisive nickname “Cuomo,” after the former Democratic governor of New York, Mario Cuomo, famous for vacillating over whether to run for the presidency in the 1980s. The White House denies the nickname. [Newsweek, 1/9/2006] Comey is not popular in the White House in part because of his 2003 appointment of special prosecutor Patrick Fitzgerald to investigate Vice President Dick Cheney’s chief of staff, Lewis “Scooter” Libby, for perjury connected to the outing of CIA agent Valerie Plame Wilson (see Shortly after February 13, 2002). And after the 9/11 attacks, Comey challenged Cheney’s assertions that the use of torture and other “war on terror” policies were legal (see January 9, 2002). Comey says he has been prepared to testify about the Ashcroft hospital visit for three years, but never did until now, because “Nobody ever asked.…I’ve never been in a forum where I was obligated to answer the question. Short of that, it was not something I was going to volunteer.” Card says that his actions at the hospital earned him bureaucratic punishment from Card. After Gonzales became attorney general, Ashcroft’s then-chief of staff, Kyle Sampson, told Comey that Gonzales’s “vision” was to merge the deputy’s office with Gonzales’s own office, stripping Comey of much of his autonomy and reducing him, in essence, to a staff member. Comey refused to cooperate. “You may want to try that with the next deputy attorney general,” Comey told Sampson. “But it’s not going to work with me.” [US News and World Report, 5/20/2007]

Attorney General Alberto Gonzales comes under fire from members of the Senate Judiciary Committee regarding the National Security Agency’s domestic warrantless wiretapping program (see December 15, 2005. Testimony from the day before by former deputy attorney general James Comey (see May 15, 2007) showed that White House and Justice Department officials were, and still are, deeply divided over the legality and efficacy of the program. But Gonzales has said repeatedly, both under oath before Congress and in other venues, that there is little debate over the NSA surveillance program, and almost all administration officials are unified in support of the program. In February 2006, he told the committee, “There has not been any serious disagreement about the program that the president has confirmed. There have been disagreements about other matters regarding operations, which I cannot get into.” Gonzales’s veracity has come under question before, and many senators are disinclined to believe his new testimony. Committee Democrats point out that Comey’s testimony flatly contradicts Gonzales’s statements from that February session. A letter from Senators Russ Feingold, Charles Schumer, Edward Kennedy, and Richard Durbin asks Gonzales, “In light of Mr. Comey’s testimony yesterday, do you stand by your 2006 Senate and House testimony, or do you wish to revise it?” And some Senate Republicans are now joining Democrats in calling for Gonzales’s removal. Chuck Hagel (R-NE) says, “The American people deserve an attorney general, the chief law enforcement officer of our country, whose honesty and capability are beyond question. Attorney General Gonzales can no longer meet this standard. He has failed this country. He has lost the moral authority to lead.” White House press secretary Tony Snow says of Hagel’s statement, “We disagree, and the president supports the attorney general.” Hagel joins three other Republican senators, John Sununu, Tom Coburn, and presidential candidate John McCain, and House GOP Conference Chairman Adam Putnam, in calling for Gonzales’s firing. Former Senate Intelligence Commitee chairman Pat Roberts (R-KS) says that Gonzales should consider resigning, a stance echoed by fellow Republican senators Arlen Specter and Gordon Smith. [Associated Press, 5/17/2007] Gonzales’s defenders say that his testimony to the committee, while legalistic and narrowly focused, is technically accurate, because the NSA program also involves “data mining” of huge electronic databases containing personal information on millions of US citizens, and that program is not exactly the same as the so-called “Terrorist Surveillance Program,” as the NSA’s wiretapping program is now called by White House officials (see Early 2004). But Feingold disagrees. “I’ve had the opportunity to review the classified matters at issue here, and I believe that his testimony was misleading at best.” [New York Times, 7/29/2007]

J. William Leonard, the director of the Information Security Oversight Office (ISOO) of the National Archives, testifies before the House Oversight Committee that David Addington, the chief of staff for Vice President Dick Cheney, attempted to eliminate ISOO in retaliation for its request that Cheney’s office report its classification activities (see 2003 and January 9, 2007). Since 2003, Cheney’s office has said that it is not required to follow a brace of executive orders mandating annual disclosure of information about its classification activities to the ISOO. According to Leonard, Addington tried to have the executive orders rewritten to abolish the ISOO and to exempt the Office of the Vice President (OVP) from oversight. James Reston Jr. [Source: James Reston, Jr]James Reston Jr., a member of David Frost’s research team for the famous Nixon-Frost interviews (see Early 1976), publishes his book, The Conviction of Richard Nixon, about those debates and their echoes in the actions of the Bush administration. Reston writes that “it might be argued that the post-September 11 domestic abuses find their origin in Watergate. In 1977 the commentators were shocked when Nixon said about his burglaries and wiretaps, ‘If the president does it, that means it’s not illegal’ (see April 6, 1977).… These brazen words… come eerily down to us through the tunnel of the last thirty years.”
Presidential Immunity - Reston writes: “In the area of criminal activity, Nixon argues, the president is immune. He can eavesdrop; he can cover up; he can approve burglaries; he can bend government agencies like the CIA and the FBI to his own political purposes. He can do so in the name of ‘national security’ and ‘executive privilege.’ And when these acts are exposed, he can call them ‘mistakes’ or ‘stupid things’ or ‘pipsqueak’ matters. In the 21st century, Nixon’s principle has been extended to authorizing torture, setting up secret prisons around the world, and ignoring the requirement for search warrants. A president can scrap the Geneva Convention and misuse the Defense Department and lie about the intelligence analyses. He is above the law. This is especially so when the nation is mired in an unpopular war, when the country is divided, when mass protests are in the streets of America, and an American president is pilloried around the world. If Nixon’s words resonate today, so also does the word Watergate.”
Echoes of Nixon and Watergate - Reston continues: “Again the nation is in a failing, elective war. A Nixon successor is again charged with abuse of power in covering up and distorting crucial facts as he dragged the country, under false pretenses, into war. Again secrecy reigns in the White House, and the argument is made that national security trumps all.… In 2007 the issue has returned with a vengeance. And one can become almost wistful in realizing that the period after Watergate brought an era of reform. A campaign finance law was passed; Congress reasserted its control over intelligence activities; and moral codes were enunciated for public officials. National security, the New York Times editorialized after the interviews, was no longer ‘the magic incantation’ that automatically paralyzed inquiry. After September 11, the incantation became magic again. And so, people have asked, after the Bush presidency, who will be his David Frost? It is hard to imagine that there will be one.” [Reston, 2007, pp. 9-10, 180]
According to Maj. Gen. Antonio Taguba, author of the most probing investigation into Abu Ghraib abuses (see February 26, 2004), many photographs and videos of the abuses have yet to surface publicly. While making his report, Taguba saw “a video of a male American soldier in uniform sodomizing a female detainee.” This video has not even been mentioned in any court proceedings. [New Yorker, 6/17/2007] Journalist Seymour Hersh, who first broke the Abu Ghraib abuse story, also claims that still unreleased photos show “other, more sexual abuse than we knew, sodomy of women prisons by American soldiers, a father and his son forced to do acts together. There was more stuff [than] was made public.” [Raw Story, 6/17/2007] The US Army’s Criminal Investigation Division (CID) continues to hold such photos and videos and declines to release them, citing ongoing criminal investigations and their “extremely sensitive nature.” [New Yorker, 6/17/2007]
A New Yorker article by journalist Seymour Hersh claims that the abuses committed at Abu Ghraib in 2003 were covered up at a high political level in order to protect a clandestine operation called Copper Green where Joint Special Operations Command (JSOC) task forces were given virtually unlimited preapproved authority to capture and interrogate high ranking al-Qaeda figures (see Late 2001-Early 2002). JSOC interrogation techniques were brought to Abu Ghraib prison right when the worst documented abuses began taking place (see (Late August 2003 or September 2003)). One anonymous former senior intelligence official tells Hersh that when photographs of the Abu Ghraib abuses were published, some in the Pentagon and the White House “didn’t think the photographs were that bad” because they put the focus on low ranking soldiers instead of on the secret task force operations. A Pentagon counterterrorism consultant also tells Hersh that the “basic strategy was ‘prosecute the kids in the photographs but protect the big picture.’” [New Yorker, 6/17/2007]
Relatives of some of the victims of the 9/11 attacks call on the CIA to release a report drafted by its inspector general into some aspects of the agency’s failings before 9/11. The report was completed in 2004 (see June-November 2004), and rewritten in 2005 (see January 7, 2005), but was not then released (see October 10, 2005). The call is backed by 15,000 signatures on a petition calling for the release. The victims’ relatives, Patty Casazza, Monica Gabrielle, Mindy Kleinberg, and Lorie Van Auken, say the report “is the only major 9/11 government review that has still not been made publicly available,” and quote Newsweek journalist Michael Isikoff saying that the main reason for the report’s non-release is “a desire to protect the reputations of some of the main figures [named in the report].” [Raw Story, 6/18/2007] This coincides with efforts by lawmakers to get part of the report published (see Spring-Summer 2007) and is eventually partially successful (see August 21, 2007).
Henry Waxman (D-CA), the chairman of the House Oversight Committee, writes to Vice President Cheney demanding an explanation for his decision not to comply with executive orders (see 2003). Cheney’s office, like other executive branch entities, is required to annually report on the amount of documents it is classifying, and how those documents are being kept secure. The annual requests are made in pursuance of an executive order, last updated by President Bush in 2003. The order states that it applies to any “entity within the executive branch that comes into the possession of classified information.” Cheney has justified the decision by saying that because the Vice President is also the president of the Senate, the vice president’s office is not strictly a part of the executive branch, and therefore is not subject to the president’s executive orders; he cites as evidence his Constitutional role as a tie breaker in the Senate. Waxman writes, “Your decision to exempt your office from the President’s order is problematic because it could place national security secrets at risk. It is also hard to understand given the history of security breaches involving officials in your office.” Waxman’s point is that, if Cheney’s office is not part of the executive branch, then it is not authorized to view many of the classified documents it routinely receives; therefore the viewing of these documents by Cheney and his officials constitutes a breach of security. Waxman writes, “I question both the legality and the wisdom of your actions. In May 2006, an official in your office [Leandro Aragoncillo] pled guilty to passing classified information to individuals in the Philippines [as part of a plot to overthrow President Gloria Macapagal Arroyo… Aragoncillo reportedly disclosed numerous secret and top secret documents to Philippine officials over several years while working in your office.… In March 2007, your former chief of staff, Lewis ‘Scooter’ Libby, was convicted of perjury, obstruction of justice, and false statements for denying his role in disclosing the identity of a covert CIA agent (see November 20, 2007). In July 2003, you reportedly instructed Mr. Libby to disclose information from a National lntelligence Estimate to Judith Miller, a former New York Times reporter. This record does not inspire confidence in how your office handles the nation’s most sensitive security information. Indeed, it would appear particularly irresponsible to give an office with your history of security breaches an exemption from the safeguards that apply to all other executive branch officials.… Your office may have the worst record in the executive branch for safeguarding classified information.” Waxman notes that Cheney’s office is notorious for declassifying information for purely political reasons, as in the Libby case. Waxman concludes, “Given this record, serious questions can be raised about both the legality and the advisability of exempting your office from the rules that apply to all other executive branch officials.” [Congress Committee On Oversight And Government Reform, 6/21/2007; New York Times, 6/22/2007] The next day, when asked what he believes about Cheney’s position, Senate Majority Leader Harry Reid will quip, “I always thought that he was president of this administration.” [Cox News Service, 6/22/2007] Five days later, Waxman will say, “I know the vice president wants to operate with unprecedented secrecy, but this is absurd. This order is designed to keep classified information safe. His argument is really that he’s not part of the executive branch, so he doesn’t have to comply.… He doesn’t have classified information because of his legislative function. It’s because of his executive function.” [New York Times, 6/22/2007]
House Democratic Caucus chairman Rahm Emanuel (D-IL) says that if Vice President Dick Cheney does not accept that his office is an “entity within the executive branch,” then taxpayers should not finance his executive expenses. Cheney has refused to comply with executive branch rules governing disclosure of classification procedures by claiming that the vice president is part of the legislative branch as well as the executive (see 2003). Cheney needs to make up his mind one way or the other, Emanuel says, and live with the consequences. Cheney spokeswoman Lea Ann McBride retorts that Emanuel “can either deal with the serious issues facing our country or create more partisan politics.” In response to a letter from Henry Waxman (D-CA), chairman of the House Oversight Committee, that charges Cheney with refusing to obey a 2003 executive order requiring that all executive offices detail the number of documents they classify or declassify (see June 21, 2007), President Bush has already said that reporting requirements do not cover either his office or Cheney’s. And McBride says that because of Bush’s decision, the question of whether the office is part of the executive or the legislative branch is irrelevant. “The executive order’s intent is to treat the vice president like the president, rather than like an agency” within the executive branch, McBride says. Many Democrats disagree. Senator Dianne Feinstein (D-CA) calls Cheney’s position “the height of arrogance,” and says Emanuel’s proposal “might not be a bad idea.” [USA Today, 6/24/2007]
John Kerry. [Source: Peace Corps]Senator John Kerry (D-MA) writes to David Addington, the chief of staff to Vice President Dick Cheney, challenging Cheney and Addington’s claim that the Vice Presidency is not part of the executive branch (see 2003). Kerry tells reporters, “It comes as no surprise that the ‘imperial president’ and his vice president are once again trying to dodge scrutiny with a ridiculous claim that Dick Cheney is not part of the executive branch of government. This is an unprecedented break with hundreds of years of history, and undermines the integrity of executive power and the Executive Order as an institution.” In the letter, Kerry writes of his concern: “[Cheney] self-designated his position as part of neither the legislative branch nor the executive branch, and is therefore not accountable to the laws that govern either branch.… This is an unprecedented break with hundreds of years of history and does not keep good faith with the hierarchy of government. While I appreciate that the Vice President has authority as President of the Senate, this does not exclude him from the executive and its oversight. Claiming to be party to neither the legislative branch nor the executive branch only serves to evade a standing executive order and bring secrecy to the Office of the Vice President.… The Vice President has routinely operated as a member of the executive branch and all the benefits and responsibilities that comes with that position. To propose that all this time the Vice President did not believe he was functioning as a member of the executive branch is disingenuous.” Kerry demands the reasoning behind Cheney and Addington’s assertions, and, in light of Cheney’s refusal to comply with reporting requirements of the National Archives as to how it treats classified documents, demands “to know what steps the Office is taking to protect classified information. This is our nation’s most sensitive information and it is critical that it is kept protected which is why the Archives does this oversight.” [John Kerry, 6/25/2007]
Dana Perino. [Source: Associated Press]White House spokeswoman Dana Perino reacts with confusion to Vice President Dick Cheney’s recent assertions that the vice president is neither wholly part of the executive nor legislative branches (see 2003 and June 21, 2007). Perino says in response to reporters’ questions: “I’m not a legal scholar… I’m not opining on his argument that his office is making… I don’t know why he made the arguments that he did.” Reporter Keith Koffler remarks, “It’s a little surreal,” to which Perino replies, “You’re telling me.” Koffler presses, “You can’t give an opinion about whether the vice president is part of the executive branch or not? It’s a little bit like somebody saying, ‘I don’t know if this is my wife or not.’” Asked if President Bush believes Cheney is part of the executive branch, Perino sidesteps, calling it “an interesting constitutional question.” After further dodging, reporter Helen Thomas says, “You’re stonewalling.” Reporter Jim Axelrod suggests Perino is denying “sky-is-blue stuff” and points out that Cheney’s assertion revises “more than 200 years of constitutional scholarship.” Koffler continues, “He can’t possibly argue that he’s part of neither [branch], and it seems like he’s saying he’s part of neither.” Perino finally surrenders, “Okay, you have me thoroughly confused as well.” Cheney’s current position—he will not comply with an order governing the care of classified documents because the vice presidency is not “an entity within the executive branch”—contradicts his 2001 argument that he would not cooperate with a Congressional probe into the activities of his Energy Task Force because such a probe “would unconstitutionally interfere with the functioning of the executive branch.”
'Neither Fish Nor Fowl' - The Washington Post’s Dana Milbank writes, “Cheney has, in effect, declared himself to be neither fish nor fowl but an exotic, extraconstitutional beast who answers to no one.” Senator Charles Schumer (D-NY) agrees, saying: “The vice president’s theory seems to be one almost laughable on its face, that he’s not part of the executive branch. I think if you ask James Madison or Benjamin Franklin or any of the writers of the Constitution, they’d almost laugh if they heard that.” [Washington Post, 6/26/2007; Wall Street Journal, 7/31/2007] Interestingly, Perino does assert that Henry Waxman (D-CA), chairman of the House Oversight and Government Reform Committee, has no standing to investigate the compliance of the vice president’s office with the executive order. “The executive order is enforced solely by the president of the United States,” she says. “I think this is a little bit of a non-issue.” The government watchdog organization Citizens for Responsibility and Ethics in Washington (CREW) retorts that, if Cheney and Perino are to be believed, then the Office of Senate Security, the counterpart to Waxman’s committee, should investigate Cheney’s office. “By claiming the Office of the Vice President is within the legislative branch does Mr. Cheney agree that he is subject to Senate security procedures?” CREW executive director Melanie Sloan asks. “The Security Office’s standards, procedures and requirements are set out in the Senate Security Manual, which is binding on all employees of the Senate.” [Raw Story, 6/24/2007]
Aziz Huq. [Source: American Prospect]Civil libertarian Aziz Huq writes that Vice President Dick Cheney’s claim that his office is not part of the executive branch and therefore not subject to compliance with executive orders (see 2003 and June 21, 2007) is a genuine constitutional crisis. Huq writes, “The term ‘constitutional crisis’ is much abused, invoked generally whenever Congress shows some life. Confrontations on war funding and Congressional subpoenas, to cite recent examples, are in fact as old as the Republic. They are but healthy sparks from a constitutional confrontation of ‘ambition against ambition,’ precisely as the Framers intended. But the true crisis is hidden in plain sight—the existence of an office in the Constitution—the Vice President’s—with no real remit and no real limits, open to exploitation and abuse.” It is nonsensical, Huq writes, for Cheney on the one hand to claim that as a member of the executive branch he has access to the most secret of classified documents, and on the other hand he is not subject to oversight because he is not a member of the executive branch. Cheney receives these documents as a senior member of the executive branch, not of the legislative. Yet, as president of the Senate, Cheney is not subject to the strict Senate rules on handling classified documents—rules far stricter than those imposed on senior members of the executive branch. Cheney’s arguments create what Huq calls a “legal black hole (another one!) where classified documents can disappear without a trace.” Huq finally asks, “Why should addition of legislative duties trigger the subtraction of executive obligations? In lawyerly terms, the 2003 order applies to ‘any’ entity within the executive branch. Having another label doesn’t stop Cheney from being one of those ‘any’ entities.” Huq says, “If it weren’t so frightening, the irony would be delicious: A Vice President who has done more than any other to push the envelope on executive privilege at the expense of the courts and Congress takes the position that his office has both legislative and executive functions so as to avoid accounting for the use of classified materials. Any veneer of intellectual legitimacy that executive power defenders have caked on their vision of a monarchical executive evaporates in the glare of this naked opportunism.… Cheney and [chief of staff David] Addington will go down in history as the most aggressive and successful advocates of executive powers in this nation’s history.… They grounded their vision of executive power on the prerogatives exercised by the British kings who were overthrown by the American Revolution.” Huq recommends that Congress clarify the situation with legislation that would clearly create a system for handling classified documents that would be binding on the entire government, including the Office of the Vice President. In a letter to White House counsel Fred Fielding, Waxman also criticizes the administration’s handling of classified information and security issues. White House staffers regularly block inspections by security officials checking for compliance with security rules, Waxman writes, but also regularly ignore security breaches reported by the Secret Service and CIA, and mismanage the White House Security Office for political reasons. And President Bush’s top political adviser, Karl Rove, recently had his security clearance renewed even though it was prohibited under guidelines signed by Bush. Rove is believed to have leaked classified information in the outing of CIA agent Valerie Plame Wilson. [CBS News, 6/27/2007]
Responding to a letter from Senator John Kerry (D-MA) that challenges Vice President Dick Cheney’s assertion that the Office of the Vice President (OVP) is not part of the executive branch of government (see 2003 and June 25, 2007), Cheney’s chief of staff David Addington seems to imply that the OVP is indeed part of the executive branch. Addington writes that the executive order in question (an order Cheney says his office does not have to follow because of the OVP’s unique status) “makes clear that the vice president is treated like the president and distinguishes the two of them from ‘agencies,’” which are explicitly covered under the order. Addington notes that on June 22, President Bush affirmed that the order does not apply to either the office of the president or the OVP. After this tacit admission that the OVP is part of the executive branch, Addington lectures Kerry on the appropriateness of his questions: “Constitutional issues in government are best left for discussion when unavoidable disputes arise instead of in theoretical discussions.…[I]t is not necessary in these circumstances to address the subject of any alternative reasoning, based on the law and history of the legislative functions of the vice presidency and the more modern executive functions of the vice presidency.” [David Addington, 6/26/2007 ] The Politico’s Mike Allen writes that Addington’s letter amounts “to throwing in the towel on the claim that the vice president is distinct from the executive branch, according to administration officials speaking on condition of anonymity, and the White House has no plans to reassert the argument.” Kerry calls Addington’s letter “legalistic” and a continued attempt to “duck and dodge on agency scrutiny, classified documents.” He calls the entire argument “Orwellian.” Two senior Republican officials say that the claim originated from OVP lawyers and not Cheney himself. Rahm Emanuel (D-IL), who has led a move in the House to strip Cheney’s office of executive branch funding (see June 27, 2007), says the reversal shows that the White House “told Cheney that he would have to come up with another excuse—that this was not sustainable in the public arena.” Emanuel says that regardless of what arguments the OVP makes, it needs to comply with National Archives regulations. After saying that if Vice President Dick Cheney does not consider himself entirely part of the executive branch, then taxpayers should not fund his executive branch office (see June 24, 2007), House Democrats led by Rahm Emanuel (D-IL) move to strip federal funding for the Office of the Vice President (OVP). Cheney has said that because the vice president is not strictly part of the executive branch, therefore he and his office are not subject to an executive order mandating disclosure of how many documents his office has classified. President Bush has said that neither his office nor Cheney’s is subject to that order. Emanuel notes that, five years ago, Cheney claimed executive privilege in refusing to release information about oil industry executives during meetings of his Energy Task Force. “Now when we want to know what he’s doing as it relates to America’s national security in the lead-up to the war in Iraq and after the fact, the vice president has declared he is a member of the legislative branch,” Emanuel says. Therefore, “we will no longer fund the executive branch of his office and he can live off the funding for the Senate presidency.” As vice president, Cheney presides over the Senate. [CBS News, 6/27/2007] The federal government, through the executive branch, pays about $4.8 million a year to fund the OVP. [Politico (.com), 6/27/2007] After Cheney’s chief of staff David Addington tacitly admits that Cheney is, after a fashion, part of the executive branch (see June 26, 2007), the Democrats drop their proposal to strip Cheney’s office of executive branch funding.
Congress Daily reporter Keith Koffler writes an article saying that Vice President Dick Cheney’s own words contradict his assertions that the vice president is not a true member of the executive branch (see 2003 and June 21, 2007). Cheney once did note he is “a product of the United States Senate” and has no “official duties” in the White House—but those words were intended as a joke. According to Knoffler, on more serious occasions Cheney has repeatedly insisted that he is a fully-fledged member of the executive branch (see April 9, 2003 and April 14, 2004). Just after assuming office, President Bush asserted the same thing (see Late January, 2001). Knoffler finds that the White House Web site notes, “To learn more about the executive branch please visit the president’s Cabinet page on the White House Web site.” Clicking on the “Cabinet page” shows Cheney to be a member of the Cabinet. The Senate Web page, on the other hand, reads: “During the twentieth and twenty-first centuries the vice president’s role has evolved into more of an executive branch position, and is usually seen as an integral part of a president’s administration. He presides over the Senate only on ceremonial occasions or when a tie-breaking vote may be needed.” [Congress Daily, 6/29/2007]
After years of wrangling over whether the Office of the Vice President (OVP) should disclose how often it exercises its powers to classify documents (see March 25, 2003), and an effort by Vice President Cheney to abolish the Information Security Oversight Office of the National Archives (ISOO) pressing the issue (see May 29, 2007-June 7, 2007), President Bush issues an executive order stating that the OVP is not required to follow the law requiring such disclosure. [Savage, 2007, pp. 164; Henry A. Waxman, 6/21/2007 ] In a letter to Senator John Kerry (D-MA) concerning the matter, Cheney’s chief of staff, David Addington, writes: “Constitutional issues in government are generally best left for discussion when unavoidable disputes arise in a specific context instead of theoretical discussions. Given that the executive order treats the vice president like the president rather than like an ‘agency,’ it is not necessary in these circumstances to address the subject of any alternative reasoning, based on the law and history of the legislative functions of the vice presidency, and the more modern executive functions of the vice presidency, to reach the same conclusion that the vice presidency is not an ‘agency’ with respect to which ISOO has a role.” [David Addington, 6/26/2007 ]
Most of the lawsuits filed against the US government and against a number of private telecommunications firms alleging illegal wiretapping of US citizens and foreign organizations (see January 31, 2006) are hampered by what legal experts call a “Catch 22” process: lawyers for the Justice Department and for the firms that are alleged to have cooperated with the government in wiretapping citizens and organizations argue that the lawsuits have no merits because the plaintiffs cannot prove that they were direct victims of government surveillance. At the same time, the lawyers argue that the government cannot reveal if any individuals were or were not monitored because the “state secrets privilege” (see March 9, 1953) allows it to withhold information if it might damage national security. Lawyer Shayana Kadidal, who is representing the Center for Constitutional Rights in another lawsuit on behalf of Guantanamo Bay detainees, says, “The government’s line is that if you don’t have evidence of actual surveillance, you lose on standing.”
One Lawsuit Has Evidence of Surveillance - But the lawsuit filed by Saudi charitable organization the Al Haramain Islamic Foundation (see February 28, 2006) is different, because the plaintiffs have an actual classified US document that they say proves their allegations. Kadidal says that because of that document, “[T]his is the only one with evidence of actual surveillance” and therefore has a much stronger chance of going forward. The Justice Department will not confirm, or deny, if anyone from Al Haramain was monitored either under the Terrorist Surveillance Program or any other government operation, but plaintiff lawyer Jon Eisenberg tells a judge in July 2007: “We know how many times [my client has] been surveilled. There is nothing left for this court to do except hear oral arguments on the legality of the program.”
Extraordinary Measures to Keep Document 'Secure' - Though the Justice Department has repeatedly argued that the Treasury Department document at the heart of the case is harmless and unrelated to NSA surveillance, it is taking extraordinary measures to keep it secure—it is held under strict government seal and remains classified as top secret. Even the plaintiff’s lawyers are no longer allowed to see the document, and have been forced to file briefs with the court based on their memories of the document. [Wired News, 3/5/2007]
Expert: Government Cannot Stop Case - The government probably does not have enough to derail the Al Haramain case, according to law professor Curtis Bradley. In August 2007, Bradley observes, “The biggest obstacle this litigation has faced is the problem showing someone was actually subjected to surveillance,” but the lawsuit “has a very good chance to proceed farther than the other cases because it’s impossible for the government to erase [the lawyers’] memories of the document.” [Associated Press, 8/5/2007]
James Marks. [Source: Military Information Technology]CNN fires one of its “independent military analysts” (see April 20, 2008 and Early 2002 and Beyond), retired Army general James “Spider” Marks, for using his position to help secure government contracts for his business. In 2004, Marks was hired as an analyst by CNN; about the same time, he took a senior management position at McNeil Technologies, where his job is to land military and intelligence contracts. As per CNN’s requirements, Marks disclosed that he received income from McNeil. But he was not required to describe what his job entailed, and CNN did not check any further. “We did not ask Mr. Marks the follow-up questions we should have,” CNN will admit in a written statement. For himself, Marks will say that it was no secret at CNN that his job at McNeil is about landing government contracts. “I mean, that’s what McNeil does,” he will say. But CNN will deny being aware of McNeil’s military business or what Marks does for the company. Marks was bidding on Pentagon contracts at the same time he was analyzing and commenting on the Pentagon’s military strategies for CNN, a clear conflict of interest. CNN will say that Marks should have been disqualified from working for the network as an analyst. During the summer and fall of 2006, for example, Marks regularly commented on the conditions in Iraq—lavishing glowing praise on the US military and the White House—while working to secure a $4.6 billion Pentagon contract for McNeil. In December 2006, Marks became president of a McNeil spin-off that won the huge contract. Marks will claim that he kept his analysis separate from his contracting work—“I’ve got zero challenge separating myself from a business interest”—but when CNN learns about his role in landing the contract, the network fires him. CNN will say, “We saw the extent of his dealings and determined at that time we should end our relationship with him.” [New York Times, 4/20/2008]
It is reported that over 1,000 civilian private contractors have died in Iraq and Afghanistan since the start of hostilities in those countries. An additional 13,000 have been wounded. The casualty figures come from the Department of Labor. Civilians work in a number of areas in Iraq, from providing security and servicing weapons systems, to more mundane tasks such as logistics, construction, truck driving, and maintenance (see April 4, 2007). [Reuters, 3/7/2004] Roughly one contractor dies for every four members of the armed forces. But despite the risks, Americans are lining up for jobs in the two war zones, lured by the prospects of high pay and, for some, adventure. As of the end of April 2007, 224 of the killed contractors were US citizens. [Reuters, 3/7/2004]

[Source: Associated Press]Attorney General Alberto Gonzales lied to Congress during Congressional hearings over the reauthorization of the USA Patriot Act (see March 9, 2006). In testimony before Congress, Gonzales asserted that he knew nothing of any abuses of National Security Letters (NSLs), documents that require employers, librarians, and others to turn over information on their employees and patrons to the government, and further require that those served with NSLs remain silent about them and the information being given over. But internal FBI documents made available on this day reveal that Gonzales indeed had been briefed about such abuses. (The Justice Department is fighting two court cases from plaintiffs seeking to halt the indiscriminate and allegedly unconstitutional use of NSLs to demand information about US citizens that, by law, should remain private.) George Christian, a Connecticut librarian who fought the FBI over its demand for information about his library patrons (see July 13, 2005 and April 11, 2007), says, “Having experienced first-hand the impact of the government’s abuse of surveillance powers, it is particularly disheartening to learn more and more about the deceit surrounding that abuse. I and my colleagues were fortunate enough to have the gag order against us lifted, but thousands more believed to have received national security letters are not so lucky, and must suffer the injustice in silence. It’s bad enough that these abuses occur, but salt is added to the wound when the top law enforcement agent in the country knows about the abuses, does nothing to correct them, and then plays ignorant when confronted with them.” [American Civil Liberties Union, 7/10/2007]
Wired News reporter Ryan Singel examines the documents released as part of the FBI’s probe into the possibly illegal use of National Security Letters (NSLs) by its agents (see Before Mid-March, 2007). Singel finds that all of the letters originate from the same room in the FBI’s Washington headquarters, Room 4944. Almost all of them refer to a “Special Project,” and the only name on any of the letters is Larry Mefford. At the time the letters were written, Mefford was the Executive Assistant Director in charge of the Counterterrorism/Counterintelligence Division. His job primarily focused on preventing domestic terror attacks. Having Mefford’s name on the letters adds another layer of interest, Singel writes: “… Mefford’s name is on documents that requested personal information on Americans. Some of those requests included information known to be false to the agents signing them. That’s a federal crime, according to one former FBI agent.” It is unclear what the “Special Project” is, outside of its existence within the FBI’s Communications Analysis Unit (CAU), which issued the NSLs in question. Why some of the NSLs requested over two pages of phone numbers as part of a single request is also unclear. Singel observes, “The documents also show that these ‘exigent letters’—essentially end runs around the rules set up to keep the FBI from trampling on citizens rights—weren’t devised by some rogue Jack Bauer-style agent [a reference to the popular TV action drama 24.]. The form letters originated from inside FBI Headquarters and in some cases, bear the name of a senior level FBI official who should have been aware of the letters’ legal grey status and possibility for abuse.” [Wired News, 7/10/2007]
Former KBR subcontract administrator Anthony J. Martin pleads guilty to violating the Anti-Kickback Act. Martin admits to taking bribes from a Kuwaiti company in 2003 in return for granting a $4.67 million contract to the firm. Although the Justice Department does not identify the Kuwaiti firm, other court documents subsequently name the firm as First Kuwaiti General Trading & Contracting (see September 21, 2007). Martin worked from February 2003 through February 2004 in Kuwait, where he solicited bids from prospective subcontractors under KBR’s largest contract with the US Army, the Logistics Civil Augmentation Program (LOGCAP III). Martin’s conviction is part of a much larger investigation mounted by the Justice Department in Rock Island, Illinois, investigating corporate fraud in the provision of logistics to the US military deployed in Iraq and Afghanistan (see October 2006 and Beyond). Martin has admitted to accepting $10,000 from the managing partner of First Kuwaiti, Lebanese businessman Wadih Al Absi. He was to receive almost $200,000 more, but testified in his plea bargain agreement that he felt guilty about taking the $10,000 and subsequently refused to take any more. Martin faces up to ten years in prison and possible restitution. [PR Newswire, 7/13/2007; Associated Press, 9/21/2007]
The White House finally releases a list of officials and organizations who met with Vice President Cheney’s energy task force (the National Energy Policy Development Group—see May 16, 2001) in 2001. Cheney and the White House have successfully battled for six years to keep virtually all details of the task force secret (see May 10, 2005), and many other documents and files pertaining to the task force remain secret. The list of participants confirms what many have always suspected—that oil, gas, and energy executives and lobbyists were virtually the only ones to have any input in the task force’s policy deliberations. Many of the participants were also heavy donors to the Bush-Cheney campaign, and to the Republican Party in general.
Secrecy - Some participants say they were never sure why the White House fought so hard to keep the information about the task force secret. “I never knew why they fought so hard to keep it secret,” says Charles A. Samuels, a lawyer for the Association of Home Appliance Manufacturers. “I am sure the vast majority of the meetings were very policy-oriented meetings—exactly what should take place.” Others say that their meetings with the task force were routine.
API Input - American Petroleum Institute president Red Cavaney says that when he met with the task force, he and his fellow API officials discussed position papers the organization had given to the Bush-Cheney campaign and to newly elected members of Congress. “We’re in the business of routinely providing advocacy materials,” Cavaney says. “Speaking for myself, I had zero hand in authoring or sitting with anyone from that task force and changing anything.” But Cavaney is seriously downplaying API’s influence (see March 20, 2001).
"Ridiculous" - Representative Henry Waxman (D-CA), chairman of the House Oversight and Government Reform Committee, who has been a driving force behind the effort to reveal the inner workings of the task force to the public, says it is it is “ridiculous” that it has taken six years to see who attended the meetings. He describes the energy task force as an early indicator of “how secretively Vice President Cheney wanted to act.” As to the makeup of the participants, Waxman is not surprised to see the dominance of energy industry groups in the meetings. “Six years later, we see we lost an opportunity to become less dependent on importing oil, on using fossil fuels, which have been a threat to our national security and the well-being of the planet,” he says. Climate expert David Hawkins of the Natural Resources Defense Council says: “Cheney had his finger on a critical issue. He just pushed it in the wrong direction.” [Washington Post, 7/18/2007]

President Bush signs Executive Order 13440, which authorizes the CIA to continue using so-called “harsh” interrogation methods against anyone in US custody suspected of being a terrorist, or having knowledge of terrorist activities. The order relies on, and reaffirms, Bush’s classification of “al-Qaeda, Taliban, and associated forces” as “unlawful enemy combatants” who are not covered under the Geneva Conventions. The order also emphasizes that the Military Commissions Act (MCA) (see October 17, 2006) “reaffirms and reinforces the authority of the president to interpret the meaning and application of the Geneva Conventions.” The order does not include “murder, torture, cruel or inhuman treatment, mutilation or maiming, intentionally causing serious bodily injury, rape, sexual assault or abuse, taking of hostages, or performing of biological experiments… other acts of violence serious enough to be considered comparable to murder, torture, mutilation, and cruel or inhuman treatment… any other acts of cruel, inhuman, or degrading treatment or punishment prohibited” by law. It also precludes acts of extreme humiliation “that any reasonable person, considering the circumstances, would deem the acts to be beyond the bounds of human decency, such as sexual or sexually indecent acts undertaken for the purpose of humiliation, forcing the individual to perform sexual acts or to pose sexually, [or] threatening the individual with sexual mutilation, or using the individual as a human shield.” The order also excludes acts that denigrate a detainee’s religion or religious practices. [White House, 7/20/2007] The order does not apply to the Army, which has numerous interrogators operating at Guantanamo and other US detention facilities. [Social Science Research Network, 3/18/2008] CIA Director Michael Hayden says, “We can now focus on our vital work, confident that our mission and authorities are clearly defined.” Administration officials say that because of the order, suspects now in US custody can be moved immediately into the “enhanced interrogation” program. Civil libertarians and human rights advocates are much less enamored of the new order. Human Rights Watch official Tom Malinowski says, “All the order really does is to have the president say, ‘Everything in that other document that I’m not showing you is legal—trust me.’” [Washington Post, 7/21/2007] In January 2009, President Obama will withdraw the order.
